They've always been top notch in this aspect. So that's great that they got uh awarded for that and got uh recognized. [0:03:57, 0:04:17]: Uh we had an award also and congratulations to the 2019 Dutchtown High School Val valedictorian, Miss Christina Welcher. I believe she's still here. Congratulations to you as well for being number one in your class. I think about a class of 377. And she also received a combination letter, as well as uh Miss Kelly Cruz received uh my first. And uh she also got recognized by Governor Kemp and also by the Secretary of State Brad Rosenverg Rosenverger, if I got to pronounce right. [0:04:37, 0:04:57]: And I received a combination for our great uh academics and leadership in this aspect as well. We recognize the 2018-2019 Youth Council, National League of Cities youth supposing sponsors, and that included Falcon Design, Georgia Power, Collaborative Firm, Waste Industries, and Valcom Institute. [0:04:57, 0:05:06]: industries as well to uh support us in that aspect for the the actual youth council trip to California uh during the course of this particular year. [0:05:07, 0:05:27]: And we also identified uh 14 and recognized 14 different uh uh youth ambassadors uh for their opinion ceremony um that they had. And this is the new youth ambassadors for the city of Stockbridge uh for and that's the deals community deals with um sorry, not City Stopridge deals with the initiative of of uh councilwoman. [0:05:27, 0:05:36]: Robinson. So those particular ambassadors uh for the twenty nineteen uh two thousand nineteen, twenty, two thousand twenty year, could you please stand to be recognized, please? [0:05:43, 0:05:52]: Thank you very much. And by the way, I'm sorry, Miss Kelly Cruz, if you're still here, could you stand to be recognized as well? This young lady got a lot of accolades and awards. Um if we could have her um to come up and be introduced, provide your her provide you her name. I okay. So just to uh'cause I think we had the um the emails were got. [0:06:24, 0:06:30]: Got switched up. Okay. Right over here. [0:06:31, 0:06:34]: Well in high school. What's your name please? Charisma Bell. Well, my name is Charisma. [0:06:34, 0:06:40]: Charisma, okay. Congratulations. Woodland High School grad, Wolfpack, congratulations to you. Thank you. [0:06:44, 0:06:47]: Appreciate thank thank you. She'll she'll get your name. Thank you, ma'am. [0:06:48, 0:07:00]: And then uh uh Alexand uh Councilman Alexander get a letter of accommodation to the Eagles Landing Community, Association for Beautification of the Eagles Landing Parkway, and announced those folks here uh earlier today as well. Sir. [0:07:04, 0:07:13]: Oh you you I'm let me move on, okay? You we well move on in this aspect. Um uh what it is now uh [0:07:14, 0:07:16]: Clerk, I think we have public comments, I I would imagine. [0:07:18, 0:07:22]: Mayor, we have several public comments for this evening. Okay. [0:07:22, 0:07:25]: First public comment is uh Noelle Collins. [0:07:26, 0:07:26]: Okay. [0:07:27, 0:07:31]: Ms. Collins, could you please come forward in uh your name and address please? [0:07:37, 0:07:48]: Hello, I'm Kimberly Collins. Where's my husband? Where'd he go? Anyway, uh my husband was with me. Um I live at sixteen forty five in Gallup Drive and Pine Grove. [0:07:49, 0:07:56]: I'm sorry, did you say Kimberly? Yes. Are you Kimberly Noel or is this a different? Oh, I'm sorry. I didn't realize my husband before he went out. Okay, Kimberly. [0:07:57, 0:07:59]: Right, that's something to know. Oh, they're calling. [0:08:03, 0:08:11]: And we're here to represent um the homeowners association with Pine Grove and the problems that we're having. [0:08:11, 0:08:31]: Um as far as the with the builders not doing anything to the pool is not open. This has been going on, the pool's not been open, no clubhouse or anything, no facilities since 2011. I've lived there since 2009. It was a beautiful facility. [0:08:31, 0:08:51]: When I first moved in, we had a swimming pool, tennis court, clubhouse. We could use these facilities. We could rent the clubhouse if we wanted to. Then during 2008, the recession, Night Builders, who was the original one that came in with another builder who only built just a couple of homes. [0:08:51, 0:08:58]: They left and left us holding everything. But the people that um [0:08:58, 0:09:18]: We're wanting them to the builders, if you could put an injunction against them, we were told that there was a lawsuit between the city of Stockbridge and these builders and that they had a certain amount of days to come in to clean up everything and to open it back up. [0:09:18, 0:09:38]: They're in there selling$300,000 homes and um have the sign out front of the entrance saying beautiful swim and tennis community and they're false advertisement. If you go on the website, it shows pictures of our swimming pool when it was opened back, you know, in 2009 and 8. But um [0:09:38, 0:09:39]: Um [0:09:39, 0:09:45]: I I just became fed up with it. Um, the people, the management that's handling it now. [0:09:46, 0:09:50]: We're not getting bills, um and um [0:09:51, 0:10:11]: I have always paid my bills on time. And this was the first year, you know, they haven't I haven't received a bill from'em in two thousand seventeen. And their logic behind it was, well, we don't want to spend the money to send out a bill. You just already know to pay your bill. Well, I feel like I don't even live in a home that's a homeowners association because [0:10:11, 0:10:23]: All they do is put pine straw down the front and they mow the front of the clubhouse is mowed and the back is mowed, but that's all we get. And we pay four hundred dollars. [0:10:23, 0:10:28]: You know, a mo uh I mean uh twice a year, January and in June. [0:10:29, 0:10:45]: This year was the first time that I was late. And I called up and I apologized when I finally found out who was handling it. And the way I found it out was from a neighbor who they were trying to um foreclose on their home, you know, for being late. [0:10:45, 0:11:05]: But anyway, I was furious. Um, they hit me with a two hundred and ten dollar ex which I thought was very excessive. I knew I was gonna get a late fee and I apologized. And they have since taken off one hundred and six dollars. But I went from door to door uh because I argued with them that I did not get a letter. Okay, ma'am. [0:11:05, 0:11:25]: Thank you. Okay, you're welcome. Thank you very much. On that note, uh I'm no no no go ahead, please have a seat, please. On that note, obviously a lot of you are here from Pine Grove. So out of curiosity, everybody's here for Pine Grove. If you can, please stand. I just want to see you, please stand. Okay, or raise your hand. Okay. All right, good deal. Now [0:11:25, 0:11:26]: Please have a sit down. [0:11:26, 0:11:46]: Because the you so many of you all here and s and so many of you signed up for comments, I'm not gonna be able to take all the comments from each one of you tonight. Okay? We have a record of of of those comments, but I'd like to limit this to maybe additional six other people, maybe an HOA leadership or or something along these lines, because if everybody spoke on this [0:11:46, 0:11:51]: So [0:11:51, 0:12:08]: So in a sense, on that note, um, you know, I know there'd more in the in the pile here, and I'm not uh one second please, and I'm not sure exactly who will speak, but we need to somewhat limit this uh in a sense to the amount of people that would do that, okay? [0:12:09, 0:12:10]: Yes, ma'am. [0:12:13, 0:12:15]: Come come come to the front, please. [0:12:16, 0:12:17]: Mm. [0:12:23, 0:12:35]: Your name and address? Yes, sir. My name is Ronette Walton. I live at fourteen twenty Gallup Drive, Stockbridge. Okay. And sir, my recommendation is that the community started [0:12:35, 0:12:39]: in phases. You had phase one, which was night group. [0:12:39, 0:12:51]: I was uh a homeowner and was sold a home in the second phase. And now the final phase is phase three, which has the new developer, which is Siverstong. [0:12:51, 0:12:56]: So my recommendation would be to hear from the three phases. [0:12:56, 0:12:59]: So that U can understand the history. [0:13:00, 0:13:03]: of a broken homeowners association where [0:13:04, 0:13:08]: People just don't pay when you can't see where your money is going. [0:13:08, 0:13:28]: That's just the bottom line. Right. Bottom line up front. All right. So you gave your name and address already. Right. And you're and uh since you're at the mic, you can speak for what phase is this now? I was I w was sold a home in uh two thousand eight, which was phase two. Okay. Knight Group was uh was the builder at the time. All right. So can [0:13:28, 0:13:38]: So continue comments and reference to if you have anything else to say continue comments and reference to first. We are discouraged. [0:13:38, 0:13:46]: And we have not been paying because we do not know where the money is going. And as uh Miss Kimberly said previously. [0:13:47, 0:13:51]: Those homes, my old and let me put in the record, my taxes went up. [0:13:52, 0:13:55]: I don't know how many people, but my taxes went up. [0:13:57, 0:14:08]: The ta the tax the tax office has to assess the community because the homes now that is going in that community is ranging anywhere from two hundred and forty thousand on up. [0:14:09, 0:14:29]: And so at the end of the day, people don't mind paying. And sir, I know you know that, but when you pay, you want to get what you're paying for. And we have had about four different homeowners associations. One of my main concerns, uh I'm sure, is with the other people, is that we wanna know the ratio of renters to homeowners out there. [0:14:29, 0:14:44]: Because it looks like there is an overnumerous amount of renters out there, and the mentality of renters to a homeowner is totally different. You can tell a homeowner versus a rental because of the way the houses are kept. [0:14:44, 0:14:55]: And at the end of the day, we want to fix this association. Our objective really is to take the homeowners association back and make put it in the home hands of the homeowners. [0:15:00, 0:15:10]: 'Cause trust me, we want our houses to stay at a a nominal value and if anyone decides they wanna sell it, we wanna sell it for what we you know, we paid for it. [0:15:10, 0:15:19]: Plus whatever the profit. We know that the real estate is on the pendulum to the to the seller right now. But at the end of the day we wanna be equally treated fair. [0:15:20, 0:15:30]: And we are very disenf enfranchised and feel we've taken advantage of and we wanna fix this problem and we wanna we wanna know what's the recourse to do that. I mean [0:15:30, 0:15:38]: We just want to be treated fairly and be treated with respect. And then what's the road to keep get this builder to do right? Because [0:15:38, 0:15:43]: With the new homeowners that are coming in here, they were assessed a eight hundred dollar. [0:15:43, 0:15:45]: Homeowner's fee. [0:15:45, 0:15:52]: And Silverstone also communicated that they had paid the Homeowners Association fifty thousand dollars. [0:15:53, 0:16:05]: And so we're saying, okay, where's this going? If you come into our interest, our interest doesn't look like it's a f you know, a two hundred or three hundred thousand dollar home community. Like she said, I've seen straw for the last eleven years. [0:16:06, 0:16:07]: Okay. [0:16:08, 0:16:15]: Right. So that's our grind today, sir. I appreciate that. Thank you very much for your time. Anybody for phase one? Phase one. [0:16:16, 0:16:20]: You serve for phase one? Come on up. And name and address, please. [0:16:21, 0:16:24]: Good evening, everyone. Uh [0:16:31, 0:16:36]: Ryan Jackson. Name and address, please sir. Just one second. I saw that in here. [0:16:37, 0:16:38]: Your fan here. [0:16:45, 0:17:05]: Okay, good evening everyone. My name is Rod Jackson, uh member of Pine Grove 1724 Gallup Drive. Uh I uh printed out the budget here for us for Pine Grove for our assessments and and what our amenities consist of. And I just want to go over that real quick. Electricity in the clubhouse uh [0:17:05, 0:17:12]: And these are all annual, okay. Electricity in the clubhouse uh four thousand dollars annually [0:17:13, 0:17:16]: Pool uh pool house water. [0:17:17, 0:17:20]: Тут аніли. [0:17:21, 0:17:23]: Landscaping and contracting. [0:17:23, 0:17:26]: twelve thousand three hundred dollars annually. [0:17:27, 0:17:28]: Pine straw. [0:17:28, 0:17:33]: in the community five thousand seven hundred dollars annually, clubhouse janitorial fees. [0:17:36, 0:17:38]: Clubhouse janitorial fees. [0:17:38, 0:17:40]: eleven hundred dollars annually. [0:17:41, 0:17:42]: Pool contract. [0:17:43, 0:17:46]: fifty four hundred dollars annually. [0:17:46, 0:17:47]: Pool phone. [0:17:48, 0:18:00]: $1,600 annually. Pool permit$6,700 annually. Pool monitor$3,400 annually. Now I went to a [0:18:01, 0:18:12]: Uh I guess this was a preliminary hearing with the city attorney because I was told that the city attorney and you guys will be blocking the building permits for this current builder. [0:18:12, 0:18:22]: And then I found out later on, well, I ride through my community, I see all these houses being completed. So my question for you guys is, uh during deannexation. [0:18:23, 0:18:36]: Pine Grove had their boots on the ground because we support the community. We stimulate the community with our economy, with our money, so on and so forth. So went since we went to bat for you guys, my question for you is what are you guys gonna do for us? [0:18:37, 0:18:38]: Okay. [0:18:44, 0:18:50]: Mr. Williams, uh since you mentioned something about meeting with attorney, do you have anything to address or can you address anything here, please? [0:18:50, 0:18:51]: Put me on this crowd. [0:18:52, 0:19:00]: Yes, sir. Um last year the city um [0:19:01, 0:19:21]: Last year the city um identified a number of code violations at in the public amenities in this subdivision. Um violations in the clubhouse, violations with the pool, some of the fencing. There's a whole laundry list of violations. So we notified the uh [0:19:21, 0:19:41]: The developer who is currently developing that Silverstone of the violations, we explained to them that under our development agreement with them, we had the right to withhold further uh building permits until they corrected the violations. [0:19:41, 0:20:01]: Filed a lawsuit. At the hearing, we went before the judge, explained our position. The judge made it clear that he felt that the city had a strong uh position at the time, but he asked us to go work it out. And so we sat in the room with the Silverstone. [0:20:00, 0:20:16]: um uh group and identified the issues and over the course of about a month and a half or two months and my timing may be off uh we worked on a settlement agreement that would have involved [0:20:17, 0:20:35]: uh Silverstone, um Rialto, and Rialto is the company that controls the homeowners association. Um and Draypak, which is the company that is seeking to develop the uh the the last phase of this, which is the Pine [0:20:36, 0:20:38]: Pine view of [0:20:38, 0:20:58]: But that the other side. Um, we were hoping to get a a three party agreement, but that didn't work out. And so at the end of the day, Draypak agreed to do all the updates and corrections in the pool house and and the pool, the clubhouse, and some of the fencing. So there's a list of [0:20:58, 0:21:01]: of items attached to their development agreement. [0:21:01, 0:21:08]: Just that they agreed. We had a conversation with the representative from DrayPack this afternoon. [0:21:08, 0:21:10]: Who informed us that? [0:21:11, 0:21:20]: i according to them, and we have not verified this, that ninety percent of the items on our list um have been addressed and that they will be applying for [0:21:21, 0:21:41]: uh a building permit and some other permits to do the remainder. Now that has not been confirmed. So I'm not here to say that it's it's it's in place, but that is the the result of that lawsuit is is uh DrayPack agreed to make the corrections. And you know it's my view that they can [0:21:41, 0:21:48]: can't um continue with their development um unless these requirements are met. [0:21:48, 0:21:49]: All right, thank you. [0:21:50, 0:22:10]: Um anybody else from the audience if what you come on up, ma'am. What phase what phase do you want to talk about? Two. Your another one of excuse me? Okay. Last phase, number three. My name is Dwayna Dawkins. I'm actually representing Francine Liken. She's the homeowner. The address is 14. [0:22:09, 0:22:15]: Yes. [0:22:22, 0:22:23]: Oh. [0:22:24, 0:22:44]: And this is giving an update. Uh you see there's a clock for three minutes. If you go past three minutes up to the council, if they want to let you more go along with three minutes. And typically what happens, folks, is that uh whoever addresses makes address here, they're addressing the the the mayor per se and the council. And all practical purposes, uh, we don't respond to these particular questions or concerns. I'll get the guidance. [0:22:44, 0:23:04]: And information from our staff, and then we'll do some follow-ups with you as time goes on. Ma'am, you now have three minutes to speak. Good afternoon, Mayor Ford and the board. Um again, Dwayne Dawkins. I'm representing Francine Liken. She's the homeowner, and it's 1413 Gallup Drive. Um, she purchased a home in uh sometime last year. We moved in. [0:23:04, 0:23:24]: In December. At the time that she um purchased the home, it was sold to her as a swim and tennis. Um, when we moved, it was in December, so of course, those amenities would not be accessible due to the weather. As it started to get warmer, she had concerns over who should she contact to get access to the um those amenities. [0:23:24, 0:23:44]: Amenities. She was told by uh Silverstone that there's a property management company, Ardent Residential. They handled the um amenities. And when she contacted them, Ardent referred her to a declarant board. At that time, they didn't say who the declar declarant board was, and the gentleman just um mentioned Rialto. [0:23:44, 0:23:57]: We have no idea who that person is. She also, again, was assessed$800, which at the time of closing, she paid a portion of that and there's still um another portion remaining. She then went back to Silverstone. [0:23:58, 0:24:07]: Біка з арт твол храна Силверстон вас оно борд. Силверстон said дати на бор, да борво з листе аз а деклар борд. [0:24:08, 0:24:28]: After further review, she went on the Georgia website and pulled down the Homeowners Association, which is currently listed as Pine Grove Homeowners Association, and is listed as the owner Walt Rayburn. He owns Silverstone Company. Silverstone also told her that they had given the Homeowners Association$50,000. [0:24:28, 0:24:48]: To fix the pool and the common areas, which, as all of the residents have already stated, those are inaccessible. The last few weeks, she's gone back over various emails, which I do not have all the details because I'm not her, but I'm speaking on her behalf. During those emails, Arden has said that the clubhouse is under reconstruction. [0:24:48, 0:25:08]: But they have not given her a timeline on the pool and it's gone back and forth. She also has all of the addresses for everyone listed at Pine Grove because she wanted to reinstate the HOA advisory group. So speaking from phase three, we have been um told that we are getting a swim and tennis community. [0:25:08, 0:25:28]: And now that we're there, there's no timeline on when the amenities are going to be used or um when we'll be able to have um access to them and it's uh uh going of a back and forth. So that's um the issue that the people who have just purchased the homes, such as my mom, [0:25:28, 0:25:31]: Mother, these are their concerns. [0:25:33, 0:25:48]: Okay, I got room for a couple more if you need to speak. Uh different phases. Is uh phase one, two or three. Yes ma'am. But phase what phase? Come on through, phase one. Name and address please. I mean she wants to she probably wants to try to get your name and see if you fill out one. [0:25:48, 0:25:49]: Yeah. [0:25:52, 0:25:53]: Why is it? [0:25:54, 0:25:57]: Shansaya, Anthony Mays. One moment. Okay. [0:26:14, 0:26:31]: I have it. All right. Go right, please. Shantae and Anthony Mays, three oh one Newburgh Place. Go right, please. Thank you. Um my husband and I moved into Pine Grove in two thousand twelve. Um since that time we have not been billed for any um assessments for our homeowners association. [0:26:31, 0:26:38]: 2018 I received I received something from an attorney threatening to put a lien on my home. [0:26:39, 0:26:59]: So they gave me a bill of$2,000 and some odd dollars that I paid monthly because I was kind of scared. I didn't want to lean on my house. But I was talking to the attorneys, asking them who do I need to talk to? Who who are who are the homeowners association groups that I need to uh speak to so I can know when is the next time I pay? What am I supposed to pay? [0:26:58, 0:27:18]: Pay, how much I'm supposed to pay. Um, upon closing, we were aware that it was a homeowner homeowners association fee. However, we never received anything until 2018 with the threat of a lien on our home. Like everyone else said, the clubhouse wasn't open, the tennis court hasn't been open, the pools, everything. So I have paid two. [0:27:18, 0:27:31]: two thousand dollars and still nothing has been open. I contacted the attorney um to ask them can they send me a covenant to see what you know I'm paying for. They still haven't sent anything. Um [0:27:33, 0:27:33]: So [0:27:34, 0:27:43]: Okay. Anything else you need to say, sir? You good? All right, thank you for your comments. Appreciate that. Okay, I think there's a hand of someone right over here. Come on up, ma'am. [0:27:45, 0:27:51]: Oh uh yeah, she was no she's phase one. What phase do you wanna talk about, ma'am? Um I don't uh [0:27:52, 0:27:54]: I think I was in phase two. What's your name? [0:27:54, 0:27:58]: Nettie Rosswiggins um seventeen thirteen calib drive. [0:27:59, 0:27:59]: Weekends. [0:28:02, 0:28:08]: Just to uh state the obvious. She's looking for one standby please. [0:28:09, 0:28:11]: Did you actually sign out she signed up one of those? [0:28:18, 0:28:19]: Let us be. [0:28:24, 0:28:33]: All right, go right in please. Okay, to state the obvious, this has been a disappointing um community. [0:28:35, 0:28:44]: In reference to I'm sorry sorry to interrupt you. Did you give your name and address, please? Nettie Ross Wiggins, seventeen thirteen Gallup Drive. I guess I'm gonna state my um [0:28:45, 0:28:47]: Comments directly to the board. [0:28:48, 0:28:52]: Number one, we have a community where the um [0:28:52, 0:28:56]: Builders lots are not being maintained. [0:28:56, 0:28:57]: They're overgrown. [0:28:59, 0:29:00]: They're [0:29:01, 0:29:05]: When they're building, they're blocking everything in the neighborhood. [0:29:05, 0:29:13]: Last weekend, because of all the rain, the streets were flooded because they had the um barriers where the drainage was. [0:29:14, 0:29:19]: They have no respect for our community when they're in the community. [0:29:20, 0:29:21]: In reference to [0:29:22, 0:29:23]: City Hall. [0:29:23, 0:29:34]: I thought that it was your responsibility to come through the communities and to say, this plot of land is not up to code. This grass needs to be cut. [0:29:34, 0:29:52]: This needs to be done. That is not being done. It hasn't been done for the last six years that I've been here. I go to this click and fix, nothing happens. I call um the inspector guy, no return phone calls. There's no attention to our community. [0:29:52, 0:30:09]: Our land value went up from fourteen thousand five hundred to twenty five hundred because we were in a planned community. We're not in a planned community. A planned community has an open pool ho uh open pool, uh open um tennis courts. [0:30:09, 0:30:29]: If you're going to the city is is is abusing us also. We know we have problems with the HOA. We know we don't know where the money is being done. When you allowed them to come in and to build that community, you guaranteed that there would be a pool house, a tennis court. [0:30:29, 0:30:30]: Court. [0:30:31, 0:30:35]: and uh um recreation um place. [0:30:35, 0:30:50]: Clubhouse. That was part of the covenant. That was the part of the agreement to come into this land space and to create. And you have not done your job in making sure that those things are available to the residents. [0:30:50, 0:30:52]: Ви архімен бії. [0:30:52, 0:30:53]: We [0:30:54, 0:30:58]: You can see by the response here. We care about our community. [0:30:59, 0:31:19]: We are in a community where everyone is abusing us. All we're trying to do is having a decent livelihood in our community where our families can grow and have a decent way of living. And it's not happening from the HOA, it is not happening from the city. [0:31:19, 0:31:38]: It's not happening from anyone. We don't even know who to contact, who to get in contact with, who to even sue at this particular point. They have been in a situation where they have gone around in a circle, round in a circle that we don't even know who to who to go to. And it's ridiculous. Okay, thank you for your comments. Time is up. [0:31:40, 0:31:40]: Yeah. [0:31:44, 0:31:53]: Mr. Knight, you'd like to address any of those comments, sir? I'm sorry? You'd like to address any of those comments. Does the city manager have o over supervisor control over the full time staff? [0:31:55, 0:32:15]: Well, I would simply say I would s simply say this. Obviously, if there are code violations, there were code violations that dealt with the clubhouse, dealt with the pool house, and so forth. That's how the city got involved in the first place and then went to court to address those particular issues in the enforceable measure that we have, which is the development agreement. And then the city um had [0:32:15, 0:32:35]: had, as the attorney had mentioned before, had developed an arrangement with um DRAPAC in particular to address those issues, and they are in the process of addressing those issues with respect to the amenity area, which is a part of the development agreement, which the city can afford and the city can enforce. [0:32:35, 0:32:55]: And so I would simply mention that obviously if there are issues with respect to any other code violations, uh lot issues, and so forth, um the lady mentioned uh just a moment ago about um those not being addressed. Obviously, if they're not been addressed uh per her request, then obviously. [0:32:55, 0:33:01]: Obviously we need to take a look at that on those items that currently may exist out there. But I would I would uh mention again [0:33:01, 0:33:04]: The city became involved initially and filed. [0:33:04, 0:33:24]: Um code enforcement citations with respect to the development agreement, which again is in the city's purview to assess, that went to court. We came out with a development agreement that addressed those particular issues that we could address as respects to the city's purview and overseeing the development agreement for the amenities. [0:33:24, 0:33:30]: Thank you, sir. Now, Council, citizens, in reference to this particular community itself. [0:33:31, 0:33:43]: I wanna allow councilwoman Need Robinson, who lives in your community as a citizen, to come here and address the council or address uh uh everything and give her three minutes as well. [0:33:49, 0:33:59]: Thank you, Mayor. You're welcome. Um Neat Robinson, six twenty-one Mohawk Circle Stockbridge. Um, Mayor and Council, I have been doing this since twenty [0:34:01, 0:34:03]: Twenty fifteen. [0:34:04, 0:34:23]: And I've come, I've been a resident f since twenty two thousand and six. I came before the council at the time. Mayor, you were a council member, Thomas and Gantt. Um there was Mayor um Tim Thompson. I stood before you and told you there was a lot of problems that were going on in our community. [0:34:24, 0:34:35]: Um I got with staff. The mayor at the time directed staff to be able to support me. We had dumping in our community, so I came out. Um they came out and they corrected the issue. Okay. [0:34:36, 0:34:46]: We've been doing this. We've had a changeover with city managers. We've had changeover with mayors. We've had a change with the Eagles landing deal. But I've been right here asking. [0:34:47, 0:34:55]: Legal and our staff to help our community. Okay. As they have stated, they actually went to court. [0:34:56, 0:35:10]: Um my community is here. We were making progress. So I did not ask for for them to even come out because we were making progress with our staff in legal once we got over the hump with the different changeovers. Okay. [0:35:10, 0:35:19]: Until this point when everything was going um perfectly fine, my question was to my colleagues was to allow staff [0:35:20, 0:35:24]: and legal to get with these developers, the declarant [0:35:24, 0:35:36]: Hold a meeting as the suggestion the it was a suggestion of the attorney to actually have a meeting at Merrill Manders so that way we can educate our community on what the city can and cannot do. [0:35:37, 0:35:40]: Educate the community on what the city has done. [0:35:40, 0:35:41]: Okay. [0:35:41, 0:35:46]: I recuse myself most recently um because apparently it got a little political. [0:35:47, 0:35:57]: Okay. I didn't want to stand before you here at all. I didn't want to do that. I wanted to allow staff and legal to do that. So I was coming to you. I was coming to you. [0:35:57, 0:36:17]: Asking for help from my community. Okay. So I had to recuse myself this last time. As they stated, they were holding different permits and everything. So I recuse myself. But we have a community that is still going up. It's now made. Um, I did an open records request so that everyone knows I just did that, so it'll be privy to all. [0:36:17, 0:36:19]: All of the people that live in pine groves. [0:36:19, 0:36:39]: All I'm asking for you is to help our community. Our community, we have a lot of Mr. Jackson, retired military, such as yourself, Mayor, Mr. Peavy, a lot of hard workers out in our community. Been there since 2006, beautiful. All I'm asking is the council to not make this political and go back. [0:36:39, 0:36:51]: Back and allow staff in legal to set up a meeting because our mayor, Mayor Forrester, he's willing to stand with them to educate and update the community because all they want to do is know who to pay. [0:36:52, 0:37:02]: Where to go and what's happening. Some people were saying, even in their community, that they were trying to plant flowers and there's concrete and trash. [0:37:03, 0:37:23]: All right. Mayor, do you mind just a few more minutes? Point of order. What's the point of order, sir? Yes, uh honestly I just think that these folks deserve uh this process to be played out fairly. This is just not the way to handle it in public comment. We should have [0:37:22, 0:37:42]: Amend the agenda and allow them to be able to uh speak freely and for the council to be able to speak on this issue to get them some answers for the timeline and the things that they're concerned about. I understand. I understand. Point of order. Wait, wait, wait, wait. Point of order, Mayor. First of all, thank you, Mayor. Even with that, I don't want the council to sit here. [0:37:42, 0:38:02]: Been coming to you. The reason why these people have come out of their homes because each one of you would not allow legal and staff to give them their information. That's why they're here. Okay. So if we can do that, I'm fine. Okay, go ahead. Um I have a point of order because when this came to my [0:38:02, 0:38:03]: Yeah. [0:38:04, 0:38:10]: I sat down with our city attorney and I sat down with our um uh city manager and our city attorney. [0:38:11, 0:38:20]: I have not been privy to a lot of this information that's going on in your community. I drove into your community. I saw the pool. I saw the community. [0:38:20, 0:38:32]: And I would not want anyone, any council member to suggest the point of order anyone up here point of order would not want to see you all whole in your community. [0:38:33, 0:38:41]: We have an open door policy and we can get you could call any of us. The point of order is that none of us sitting up here, none of us. [0:38:42, 0:39:02]: Wants to see any community going through what you all are going through. I can personally say that and I can personally speak for every council member up here. We're here to sit here and move this city forward, and if that involves you all, we want to see that happen. Okay. And that's where we stand. Okay, on that note, on that note, what we're gonna do, one one second, sir. What we need to do. [0:39:02, 0:39:22]: Obviously the uh the you all have been working doing some things of uh for other the staff, all right. And there's a certain amount of responsibility that the city has versus uh what uh a HOA actually has. You know, I'm I'm I'm an HOA myself as well and I sit on the board of my HOA. So I know the certain things as a board member you you have responsibilities for. [0:39:21, 0:39:34]: that are outside of purview per se of the city. City has more type of responsibility of certain things as well. Now uh and I and I yes ma'am? Mayor for I need to approach you Yes come on please. [0:39:41, 0:39:44]: To put it on your channel so we can talk about it. [0:39:45, 0:39:47]: This ain't gonna help nothing without talking about it. [0:39:50, 0:39:54]: You need to let them do what they were doing. [0:39:55, 0:40:02]: They they giving them the money, they just need to go ahead and do it. [0:40:02, 0:40:09]: If you put it on the agenda we can talk about this ain't this is crazy right here.'Cause they ain't gonna get no answers. [0:40:11, 0:40:12]: What happened? [0:40:14, 0:40:19]: If you get it put on the agenda so we can talk about it. I I would say. [0:40:19, 0:40:21]: So we put it on a ditch. [0:40:22, 0:40:24]: We can't. [0:40:25, 0:40:45]: Mayor. All right, folks. Point of order. She got one. Mayor. Yes, ma'am. Is there a way we can put this on our agenda so that way the council can actually discuss this? So that way we can get help. Second. No, hold on a second. It's you said you had you asked me a question, you didn't do a motion. The point of it is is that uh [0:40:45, 0:40:56]: Before we go any further, uh obviously this is the meeting's already started. We've had the we have open discussion. Don't don't need to be labored this on on for everybody's comments. We'll have the general idea of this. Now. [0:40:56, 0:41:03]: For you attorney, I mean just in the sense of we have plenty of other things to do tonight as well. And I know we'll we'll address this issue as time goes on. [0:41:03, 0:41:05]: But trying to [0:41:05, 0:41:09]: go back through the process to amend the agenda after we originally amend it. [0:41:10, 0:41:15]: is is is something that uh it doesn't make quite I'm not sure if remember makes quite sense to do that at this point. [0:41:17, 0:41:19]: No, go ahead. What's your legal advice? [0:41:22, 0:41:25]: Do it. Okay. [0:41:26, 0:41:27]: No motion. [0:41:27, 0:41:41]: Okay. Now on that note then you you initially you made a comment. I made the motion there. What's your what's your motion please? The motion is that we discuss this now. Our citizens are here and I would like to put it on the agenda. [0:41:47, 0:41:51]: Second, second. All right. I don't think there's any fur hold on, sir. [0:41:51, 0:41:55]: I I don't think there's any further discussion on that. All in favor of the motion, please indicate. [0:41:57, 0:42:10]: All right. Okay now hold hold on, sir. I've got this. Okay, so it's been been approved to to have this discussion uh in this aspect. Now, um on that note [0:42:11, 0:42:13]: Sir, since you have been i itchin'. [0:42:14, 0:42:21]: Okay. Come on up and give your name and address please. And we'll we'll we'll listen to this gentleman and then we'll discuss this openly with the council. [0:42:23, 0:42:24]: This is the way to do that. [0:42:25, 0:42:28]: My name is Byron Pratt, four twenty four Brunswick Circle. Yes. [0:42:30, 0:42:38]: I've been in a community two years. Okay. Just bought. Let stand by a second. Let her let her find your. Did you fill out one of those documents? Sure, did you let her find it first? [0:42:55, 0:43:00]: Correct. Did you say you were gonna speak or not? [0:43:00, 0:43:05]: Okay. Okay, you didn't put it. [0:43:06, 0:43:08]: I didn't know you had recently. [0:43:10, 0:43:10]: Okay. [0:43:13, 0:43:15]: They got$50,000, fix it. [0:43:17, 0:43:18]: Right. [0:43:19, 0:43:20]: Exactly. [0:43:23, 0:43:25]: These are eight joke danger. [0:43:26, 0:43:38]: I'm not sure what phase. I just I just you know what I'm saying, I've been there two years. All right. Okay. Good go ahead and address please. Four two four Brunswick Circle. Okay. Thank you. Go right ahead. [0:43:39, 0:43:45]: So I just basically got a question. You know, we get uh letters in the mail telling us to put our trash cans and things like that up, hide'em. [0:43:46, 0:43:47]: They don't want to be seen. [0:43:48, 0:43:55]: We all know the problem of mosquitoes in Georgia. We got a green pool. How do we know that they're not growing in there? [0:43:56, 0:44:00]: I'm just saying dogs walk, my kids walk, my daughter actually [0:44:00, 0:44:02]: is, you know, allergic to mosquitoes. [0:44:02, 0:44:03]: I love. [0:44:03, 0:44:05]: Right on the other side of the pool. [0:44:05, 0:44:06]: Is green. [0:44:06, 0:44:07]: Okay. [0:44:08, 0:44:11]: How do I know that they not growing in there? I ain't seen a truck come through spray, no nothing. [0:44:12, 0:44:16]: Before then I I lived in Ellenwood. I used to see a truck come through all the time in Ellenwood. [0:44:16, 0:44:19]: I heard Stockbridge was better. Don't seem like it to me. [0:44:20, 0:44:28]: All right. I'm just I'm just saying. All right. We'll we'll address that, sir. Okay. Okay. Appreciate your comments. All right. Thank you very much. Thank you. All right. [0:44:28, 0:44:48]: Okay, on that note, stand by please. On that note, now we've heard si six different citizens in this group, along with fellow council member Neat Robinson, all right, in reference to so now I guess in a sense now dialogue with the council in reference to this particular issue. I think you've got the gist of what the citizens are talking about. And so in that [0:44:48, 0:44:57]: So I'm gonna go back to Miss Robinson first. That you live in the community. She's if additional comments that you may have. Go right in, please. [0:44:58, 0:44:59]: Thank you, Mayor. [0:45:01, 0:45:07]: And I just thank my colleagues, that of being complaining, because this is near and dear to my heart and [0:45:07, 0:45:08]: My residence. [0:45:09, 0:45:14]: No matter how long it takes me to talk, I'm talking for not only myself, I'm talking for them. [0:45:15, 0:45:18]: And it's time out for my colleagues trying to shut me up. [0:45:19, 0:45:23]: Because at the end of the day, we're having to deal with this. [0:45:23, 0:45:25]: We're having to deal with this. [0:45:25, 0:45:40]: It's not political. As I stated standing there, twenty fifteen, I was having meetings in my home with the previous city manager. Mr. Jackson, Mr. Peavy, they can vouch for it. It wasn't political. I didn't want to bring it up to be political. [0:45:40, 0:45:43]: I just wanted to do what was morally right. [0:45:44, 0:46:04]: But when it got here, for some of those that's saying, okay, they wanted to um they didn't know about it, those are lies. I've been screaming since 2015. Point of order, Mayor. Again. Stand by, please. So, Mayor, what I need for our community is for this council to put us at the top of the list, like they did for [0:46:04, 0:46:05]: Eagles Landing. [0:46:12, 0:46:15]: Councilman Alexander, might as well come down this way. Go ahead, sir. [0:46:15, 0:46:35]: Yes, uh I fear your pain. I do. And uh if any of you all follow me, you know tonight we gave out a beautification award uh for a community that was doing a great job. It em it matters to me when lots are overgrown. It matters to me when citizens aren't uh property values aren't [0:46:35, 0:46:49]: Aren't being protected. You know, I personally champion seven days a week code enforcement. And when a citizen comes in here to this microphone and says to me that they've been calling and their phone has not been answered or their call is not that's not that's unacceptable. [0:46:50, 0:46:51]: That's not okay. [0:46:51, 0:47:11]: Your answers should be your phone call should be answered. The code enforcement is out there from eight to five every day of the week, seven days a week. When you don't get the appropriate response, you reach out to myself or any of these council members up here, Councilwoman Robinson, we get involved to get that call returned. Because these builders do have a responsibility. [0:47:11, 0:47:12]: Responsibility to you. [0:47:13, 0:47:18]: They have a responsibility to help you maintain your property values because please believe [0:47:19, 0:47:39]: Under the law in the state of Georgia, these HOAs are omnipotent almost. They can do almost anything that they want to do to you because that lien letter has weight behind it. Because whether they send you the bill or not, when you go to sell your house as a realtor, there's gonna be a lien on your house. It could be for$3,000,$4,000. [0:47:39, 0:47:56]: You're gonna have to pay it. We gotta get that solved right now today. As a member of this council, this came to us. We discussed it. Uh we had authorized the payment to be made uh in in this agreement. Now I want to understand why. [0:47:56, 0:48:16]: These facilities have not been repaired and what is the timeline between getting them from zero to a hundred percent. So I wanna inquire of the city manager or the city attorney, what is the timeline behind getting these facilities up and running and what is it that we can do? [0:48:16, 0:48:36]: To make sure that we get somebody out there and the code enforcement out there on the gripes that have been made with these lots being overgrown because we have that the code enforcement on that right now. In these particular communities, we should step up. We need sidewalks out there connecting these. [0:48:36, 0:48:56]: Particular communities, we need to make sure that that these citizens, as they said, I live in the Eagles Landing area. I do. I fought for this city just like you do to keep us together and to keep Eagles Landing in the city because it's one city. One area should not be weighed more than the other, and we need to make sure. [0:48:56, 0:49:11]: that the same standard is applied 100% throughout the city in terms of beautification. But let's not leave here tonight without having a timetable to have these facilities up and running. And can you speak to that, uh Mr. Williams? [0:49:19, 0:49:26]: Provided that the uh DRAPAC was to do the work. The contract was signed actually the first part of April. [0:49:27, 0:49:34]: Um, we were under the impression uh at the time they said it would be about two or three weeks. So it was actually [0:49:34, 0:49:37]: It came as a surprise to find out as of [0:49:38, 0:49:44]: uh last week that they hadn't even applied for any building permits. And so there clearly needs to be [0:49:45, 0:49:50]: some follow up with uh code enforcement to go out and do a walkthrough to confirm [0:49:50, 0:50:10]: what has and has not been done per the contract because it's my opinion that they cannot proceed on the Pine View development until they satisfy these requirements. So so as a follow up, when can we get back to these residents or with an answer from this particular these two entities? When will [0:50:10, 0:50:17]: We they be able to come back as a built in follow up that we're gonna have the answer that they're looking for. [0:50:19, 0:50:30]: I'm I cannot speak for your staff, but it it it it seems to me that uh y you know, we can have walkthroughs as early as this week and then we can report back at the next council meeting. [0:50:31, 0:50:34]: All right, on that note then, Mr. Knighton, can you answer that question, please? [0:50:35, 0:50:45]: Um related to uh what Mr. Williams said, the the correspondence we received even as late as this afternoon uh from a gentleman with Saint Bork, which is Draypack. [0:50:45, 0:51:05]: Was that there were a number of items that had already been completed, a number of other items that would be completed by the end of this week, calling for a walkthrough by the end of this week with our building inspections department to ensure that they have complied with everything that we placed on the development agreement to be. [0:51:05, 0:51:18]: be um addressed. So we can certainly uh follow up with the counsel at the end of this week and I think uh to the attorneys uh point by the next meeting certainly uh we would be able to uh update the public at large if not before then. [0:51:19, 0:51:33]: All right. Thank you, sir. Uh Ms. Gantt, do you have any c you have any comments you'd like to mention? I do. Um thank you guys for attending tonight and expressing your concerns about your community. Um a lot of the discussion I've heard thus far. [0:51:34, 0:51:39]: And uh forgive me, Mayor, but I'm gonna put my other hat on real quick. I'm a real estate attorney. [0:51:39, 0:51:41]: Sounds like you need to get together. [0:51:41, 0:51:48]: in one of your c in your community and go find you a good attorney and whip the developer's butt, basically. [0:51:49, 0:52:05]: That's what it sounds like. It sounds like you have a response the responsibility there are two types of responsibility here. There are two types of responsibilities. When it comes to spraying for mosquitoes, if that's something that the city does, we can handle that. [0:52:05, 0:52:25]: But when it comes to the cut, you know, we have HOAs in other subdivisions. I live in a a very large subdivision, Marnark Village, and the HOA will come around and send a bill if your if your um grass is too high or if your trash cans are out. That is not the city. The city [0:52:25, 0:52:45]: Does not have a city property tax. Someone mentioned property taxes. They're increased. Take that up with the accounting and appeal it if you don't think that it's properly done correctly. There are other issues that you guys mentioned. You're paying$400 every in January and in June. I took notes. [0:52:45, 0:52:50]: You're paying$400 in January and in June of each month. [0:52:51, 0:53:01]: That is okay, I mean each year. Those responsibilities of your HOA, of your property management company, those are things that you need to reach out to an attorney. [0:53:02, 0:53:22]: And say, listen, these are our issues. We can't get anywhere. The city, when we did find out about those issues, I believe that in 2013, 2014, Mr. Harris. Um, what we what we have done in the past in regards to any type of violation that the city can. [0:53:21, 0:53:29]: Write a code upon. Once you find out who the person is we can contact, from my understanding, they're up in New Jersey. [0:53:29, 0:53:32]: Right? So there are a lot of things that [0:53:33, 0:53:53]: One, you have to know who your who your venue is. Who's the person that you're contacting? Is it responsibility of the city or is it the responsibility of the HOA? And then your responsibility is to go after those people. You guys are being what I call the HOA property management company receiving$400. [0:53:53, 0:54:05]: every twice a year from each household is receiving what an unjust enrichment because if all they're doing is laying out straw, then that's who you target. That's who you're going after. [0:54:05, 0:54:09]: and and in regards to that [0:54:09, 0:54:18]: In regards to that, I'm not saying that we won't do our part to try to help, and that we have not done our part to try to help. [0:54:18, 0:54:38]: We filed the citations. We've asked for some type of resolution. And in regards to whether it's a street maintenance issue, a mosquito issue, some type of hazard that we can do on our side, then so be it. But please believe I I think that you need to get you a good attorney. [0:54:38, 0:54:47]: I I'm I'm I'm I do a lot of real estate work myself and I'ma tell ya, I I think that I couldn't see one attorney not taking this case. [0:54:51, 0:54:53]: Miraportan Blount. Go ahead, please. [0:54:53, 0:55:08]: Um yes. Um this when this came to my attention, I came into office January of of twenty sixteen. When this came to my attention several weeks ago about what was going on in your community. [0:55:09, 0:55:18]: Um, our city attorney at the time, we sat out and we was talked about something that had already been negotiated with uh Silverstone. [0:55:18, 0:55:38]: for any future development in that community, that certain standards and certain amenities had to be uh built on in a an amount of twenty somebody mentioned fifty thousand, but I remember in that negotiation that an amount of twenty thousand dollars was to be given toward those amenities. As of [0:55:38, 0:55:39]: As of today [0:55:41, 0:55:44]: We thought that this was a done діal. [0:55:44, 0:55:48]: We just fa I personally just found out today. [0:55:49, 0:55:50]: I just [0:55:50, 0:55:58]: No, no, no. Hold on, hold on, young man. What I'm saying is, is when this was brought to us, when I said I didn't know, I said I was in preview. [0:55:59, 0:56:19]: Ms. Robinson says she's been doing this since 2015. I don't know anything about that. Only thing I know about, point of order. Only thing I know about is when Mr. when I told you all before earlier, I sat down with Mr. Knighton and Mr. Williams, and I was told that before any other development started in your community. [0:56:19, 0:56:25]: That these amenities were going to be paid for. And when I found out that they wasn't was today. [0:56:26, 0:56:35]: This is when it came to us was the day that I find I'm just now knowing that whatever was said Point of order mayor none has been done. I'm telling you about me. [0:56:36, 0:56:39]: I'm the type I'm a type hold. [0:56:40, 0:57:00]: Hold hold hold up hold up folks. Hold up. Stand by stand by Ms. Blount. Stand by Flint. Hey, hold on, folks. Hold on. Let me hold on, people. Okay, let me tell you. I mentioned to you earlier there's a whole bunch of y'all in here. Everybody is not going to speak. We'll be here all night long. We can't do that. We're not going to do that. I reheard set these six different people, along with a resident that's a council member. [0:56:59, 0:57:19]: on this issue. Our attorneys has already spoken, our uh city manager has spoken, they'll probably speak a little bit more. You just gotta pay attention, listen. We're why I'm trying to work through this process. You all that have your hands raised up, uh chances are you're not gonna get a knowledge tonight. You've already we've already had enough people speak. We got the gist of this information. We understand. I'm pretty sure we understand. So I'm gonna let Mr Blount, Mayor Pro Tem Blount finish. [0:57:19, 0:57:31]: And then we'll move on to Mr. Mr. Thomas here. Go ahead, please. I just finished talking to our city about two uh communities today. My community, one song, and about McCain Creek. [0:57:32, 0:57:34]: When we when I heard today that [0:57:34, 0:57:54]: That you all were coming down here because nothing that was negotiated has happened. This is something that this council needs to look at. And these none of us up here are the villains. No matter who talks the loudest or who shouts or whatever, we want to see your community being put in a position that you all paid for. If you look at how I've always voted. [0:57:54, 0:58:14]: Since I've been on this council. When menages are supposed to be provided, I voted that they be provided. And when I see a community like you all, a community that would come together and want something done, then we should do what we're supposed to do to help get it done. We shouldn't be helped going back and forth with all, let's just get things done. We can talk all day and talk all night. You all want to see action. [0:58:14, 0:58:20]: Because it's been going on too long. And I'm telling you right now, that's what we want to see up here. [0:58:21, 0:58:27]: And we say we don't want to see politics play a part. I don't either. I hate politics, but I love serving. [0:58:28, 0:58:44]: And so I'm sitting here to tell you, look at my track record. I'm not sitting here coming against not one of you, because we could be sitting very well in the same position you're fit sitting in. And what we we would want to see the city back us, just like you all coming and saying, hey, I want the city to back. [0:58:44, 0:58:48]: We need to go to these people that have negotiated with us. [0:58:48, 0:58:52]: and told us what they were gonna do in your community and haven't done it. [0:58:52, 0:58:59]: And these are the people we need to talk to because not only you all are being lied to, we all are being lied to. [0:58:59, 0:59:06]: And so that's when we need to get on board and do what we have to do. And I can promise you from my end and my colleagues. [0:59:06, 0:59:16]: Do whatever they we need to do, but we're gonna make sure on our end what was told to us, you all would be facilitated with what was told to us, or we would have to take action on our end. [0:59:17, 0:59:18]: Thank you. [0:59:18, 0:59:19]: Mr. Thomas, please, go ahead, please. [0:59:20, 0:59:21]: Thank you, Mayor. [0:59:26, 0:59:28]: Sir, Mr. Thomas has got the floor. [0:59:29, 0:59:30]: Mr. Thomas Go Rideson. [0:59:33, 0:59:35]: I'm gonna try to tone [0:59:36, 0:59:38]: This meeting down just a little bit. [0:59:40, 0:59:45]: I was born here in the city of Starkbridge. I've been on the council for a while. [0:59:45, 0:59:48]: I campaign in this neighborhood. [0:59:48, 0:59:50]: And I'm about [0:59:50, 0:59:56]: keeping my word when I campaign and what I tell citizens that I'm going to do. [0:59:57, 1:00:02]: We've heard a lot here from you all today. I've heard a lot from my colleagues. [1:00:03, 1:00:15]: And my colleagues know I'm not about the round and the round, the arguments, throwing blame. I made a note here, I'm about results. Results. [1:00:15, 1:00:20]: It does none of us any good to throw any blame here. [1:00:20, 1:00:23]: I commend all of you for coming. [1:00:23, 1:00:26]: this evening because I used to be on that side. [1:00:27, 1:00:37]: And I was one of the same ones that were coming for the mayor and the council as a citizen to do exactly what you're doing. So I don't have an issue with what you all are doing. [1:00:38, 1:00:56]: So, with that being said, I'm trying to make notes of how do we get results? I'm not going to throw any blame. We've heard the issues. So the conversation needs to be: how do we get results? Now, I heard one thing about code enforcement. [1:00:57, 1:01:04]: We're going to make sure that code enforcement from the city standpoint come out and do their job. That's number one. That's results. [1:01:05, 1:01:10]: the developers and the agreement and the contract. [1:01:10, 1:01:16]: From the city standpoint, and we have uh our community development director here. [1:01:17, 1:01:19]: So we're going to see [1:01:20, 1:01:27]: And we can make sure that that is maintained. Again, that is a result. So listen everyone, please. [1:01:29, 1:01:43]: Let's talk about results. We know what the issues are. Y'all have done a great job in letting us know what the issues are. As Mrs. Gantt indicated, some of those things are not in our purview. [1:01:44, 1:01:51]: Your homeown association, your taxes and things like that. We have nothing to do with that. So let's make sure that [1:01:51, 1:01:54]: We narrow this down to what you [1:01:54, 1:02:14]: As citizens of the city of Stockbridge, and we are elected officials that represent you, what is it that we need to do to resolve this issue? Now that's what we need to hear. So I have just a couple of things, and hopefully now the conversation will go toward results. [1:02:14, 1:02:16]: What is it? [1:02:16, 1:02:25]: that we need to do and what is that we can do to resolve the issue. So we're talking about results. So please [1:02:26, 1:02:31]: It's not political. We done need we don't need to throw the blame game and all of that. [1:02:32, 1:02:39]: Let's talk about what is it that we need to do. So, Mayor, when I finish, the first thing I need to hear from someone is to say, [1:02:40, 1:02:46]: This is the first thing we would like for you all to do. Now I've heard about code enforcement, but that's what we need to [1:02:46, 1:02:48]: Challenge us. [1:02:48, 1:02:53]: What one stops [1:02:54, 1:02:57]: After today starting tomorrow [1:02:58, 1:03:02]: putting something in motion to resolve the issue. [1:03:03, 1:03:06]: That's what we're about. That's what we need to hear. [1:03:07, 1:03:13]: We don't we don't need to hear what the issues are. We got a good idea. We don't need to throw a blame on anyone. [1:03:13, 1:03:18]: It's all about results. So, Mr. Mayor, what is it? [1:03:19, 1:03:21]: What is the very first thing one second? [1:03:21, 1:03:41]: that we as a city need to do for this community. Thank you. Hold on, hold on, folks. Hold on. Hold on. Hold on. Okay. Mr Mr. Knighton, initially in your comments you talked about uh getting some you had a report, some type of report. You had to validate I guess the report that came out from uh from the uh [1:03:41, 1:03:50]: uh builder, I guess it is, and you want to validate that by the week's end, the things that they said they done, and you want to do that with code enforcement. I'm assuming that's what you were indicating. Is that right? [1:03:51, 1:04:06]: Right, the code enforcement and the building inspections department. There were a number of things, a laundry list of things that we had required from the um uh developer group to make sure w they addressed and a number of things they have addressed. [1:04:06, 1:04:11]: There still are several things that they have not addressed which they say according to the email that I received. [1:04:12, 1:04:13]: That they say [1:04:13, 1:04:15]: They will address by the end of this week. [1:04:16, 1:04:20]: And so those I stand by folks, stand by please. [1:04:21, 1:04:41]: Mayor. Okay, well Stampa, I will get to that. Okay. And y okay, Nessaspee. Relax please for a second. So in reference to I just want to make sure we got got that settled and what you received in the email. Okay, so they highlighted say these things are done. You gotta validate these things, and these items you're referring to are exactly what did they say? [1:04:41, 1:04:42]: In an email. [1:04:42, 1:05:01]: Yes, sir. If I if I read this, it'll be a long time. I I'll I'll be glad to do that. But there are number things. Hold on. Hold me. People relax, please. Relax. Okay. Yes, sir. Take the time and effort to to generate what that is and help satisfy some of this requirement. I I see you. I'll get to you in just a second. [1:05:01, 1:05:02]: I'll get to you in a second. [1:05:03, 1:05:23]: About three or four pages worth of three or four pages of this. Yep, Mayor. Okay, yes. Well, okay. Stand by standby. Yes, Miss N. Thank you. Thank you, Mayor. Again, I just want to say this: the attorney and these um the legal and the staff have been working on this. Everything was working fine until a certain point. All we needed [1:05:23, 1:05:43]: This point because we all are saying we cannot reach anyone. The attorney can reach them. The city can reach them. The attorney had mentioned that we have a town hall with everybody in the building. So that way, this three pays that he has, the citizens, which is us, [1:05:43, 1:06:03]: The residents, we can be at the Merle as the legal stated. And just like we're here, we can say all day long what our problems are. We can't reach anybody. So all we're needing is for everybody to get to the table. And the city has the ability to bring them to the table. And you [1:06:02, 1:06:22]: Yes, yes, yes. Let me let me explain that. The city has the ability because that's what we were getting ready to do. They were gonna have a town hall to let every citizen know what Dray Pack, what everybody responsibility is. Am I right, City um Turney? [1:06:22, 1:06:25]: Everything was going fine. [1:06:25, 1:06:45]: And that's what he was his his um suggestion was, so that way we can clear the air and make sure everybody knows what's going on. Because if we keep doing this, everybody keeps saying this is the first time I'm hearing about it, we're gonna go round and about. So again, certain things that we talked about that I'm not privy to. [1:06:45, 1:07:02]: That we discuss in executive session, but at least the attorney can be able to tell us what he stated to me as a residence. Because I was told when this took place, going to court to stand down. So I, as an elected body. [1:07:03, 1:07:23]: and a resident have no clue because I was asked by legal to stand down. So when they asked me to stand down so there wouldn't be any legal problems, now is when he stated that we need to bring all of these people who we're holding accountable to the table. And Miss Moore was there. [1:07:23, 1:07:23]: All right. [1:07:24, 1:07:44]: Go right ahead, Camilla. Great. The issues uh that were laid out from building and permitting basically dealt with the facility itself. Okay. So therefore, uh we ask that internally all of the electrical be brought up to code. Uh all of the HVAC be brought up to code. [1:07:44, 1:08:04]: Code. Make sure that there's no water damage in the building, brought up to code. Make sure that the windows which were boarded be unboarded and brought up to code. Make sure that the appropriate fencing around the pool be brought up to code. Make sure that the pool be emptied and filled correctly and make certain. [1:08:04, 1:08:24]: Suitable for residents to swim in, brought up to code. Make sure that the existing other facilities, auxiliaries, such as the tennis courts, all of the other entities that were part of the package be brought up to code. Now, the only way that the city can do that is by citing those violations. [1:08:24, 1:08:38]: We can hold them to account only based on the violations. Who pays for it was put in the contract between the parties that are involved. It is up to them. [1:08:38, 1:08:46]: to repair it, the only thing the city can do is continue to cite them for the violations. [1:08:47, 1:09:07]: And those are the violations. And one thing that was in there was to make sure that the new developer of Pine View is not able to build a single home until the amenities at Pine Grove have been brought into compliance. [1:09:07, 1:09:11]: So what that means right now is that [1:09:11, 1:09:13]: Pine View. [1:09:14, 1:09:34]: Has set aside the monies to bring the units and facilities into compliance. Tomorrow I will personally go out to the site to verify what has been brought into compliance, what has not. We will report back to you the status. [1:09:34, 1:09:54]: Of bringing all code violations into compliance. As it relates to forcing them to do anything right now, from my understanding, legally, because this is a private entity outside of code violations, the city cannot do it, but the HOA can hire an attorney. [1:09:54, 1:10:05]: to help the city as we cite to put pressure on Pine View and Pine Grove folks to move forward with their compliance issues. [1:10:06, 1:10:08]: Clarification. Okay. Okay. Now [1:10:09, 1:10:27]: Thank you for your comments sir. Appreciate that. Mr. Knight, uh in your particular email, you says three pages long. Is there some things you can make a small synapses, a point of contact? I mean, some highlighting. I mean, I imagine there's some things that she's already mentioned. Right. There was there was a laundry list of items that were supposed to be done. Right. A number of those items have been done. [1:10:27, 1:10:28]: Okay. [1:10:28, 1:10:36]: So then you've got the other list, a much shorter list of those outstanding items that still need to be done, which they say they will do by the end of the week. [1:10:36, 1:10:42]: That's an email. Okay, I'm going by. And obviously we'll have to verify what has been done and what will be done by the end of this week. [1:10:42, 1:10:47]: One second please. Mr um uh go ahead, Mr Williams, you wanna say something, sir, I guess. [1:10:47, 1:10:49]: Well you're good. No, you're not going to be able to do [1:10:53, 1:11:00]: There's a clarification about the homeowners association. Right now, the homeowners association is controlled. [1:11:00, 1:11:03]: by Rialto. They are the declarant. [1:11:03, 1:11:08]: So one of the things in an earlier draft of the agreement we're [1:11:08, 1:11:10]: We had had discussions about [1:11:10, 1:11:17]: uh their moving forward to transfer the homeowners association control to the actual homeowners. [1:11:18, 1:11:18]: Right. [1:11:18, 1:11:21]: But that did not make it in the final version of the agreement. [1:11:22, 1:11:28]: All right, so all right. So actually if there's any type of action that the the the citizens on that particular [1:11:29, 1:11:47]: that particular community wanna make against the the HOA, they're really going against this this e each each homeowner is a member of the homeowners association. Right. To the extent that the declarant Rialto has not fulfilled their obligations under [1:11:47, 1:11:51]: the covenants that the homeowners potentially have a class action lawsuit [1:11:52, 1:11:53]: against [1:11:53, 1:11:54]: Realto. [1:11:55, 1:11:58]: But that's a private contractual r relationship. [1:11:58, 1:12:10]: And in that type of relationship we we the city cannot get involved in that particular relationship. We we don't have any direct involvement in that. We have indirect involvement to the extent that the homeowners association [1:12:10, 1:12:30]: Rialto was not maintaining the the the the amenities, et cetera city code. Yes. Okay, and that's where the sighting comes in and that's where the review comes in in reference to what they've already said they have done and then we have to validate what they've done and then what they still have to do and make sure that they do those make everything up to code. Now so we have an [1:12:30, 1:12:50]: Update by the end of the week by tomorrow will be some type of update by the end of the week be an initial update, and I'll imagine by the next time we meet officially, which will be at the end of the month for our work session to be further updates on this aspect as well. I got a question. Okay. Well, go right ahead. Well, go ahead, sir. Mr. Williams, w when we sat down with them and they talked about um [1:12:51, 1:12:56]: uh taking care of these amenities. We did that as a city, right? [1:12:56, 1:13:08]: Yeah, so they they they to address the code violations of the case. Yeah, but the reason I'm asking that if if the city sat down with them to negotiate terms that they had to stand by, then it's not on the [1:13:09, 1:13:17]: It's not on them, it's on us to to to up to for them to buy by what we had in an agreement with them. Yes, sir, as it relates to the agreement, but [1:13:18, 1:13:22]: A number of the complaints aren't about the amenities, they're about [1:13:22, 1:13:23]: The fact that [1:13:23, 1:13:30]: they they can't find anyone to talk to to to rent the the clubhouse if they can't find anyone to talk to [1:13:32, 1:13:40]: Yep, yep. But those those are minutes. Mr. Nighton, uh real quick, is anything that is being said here tonight? [1:13:40, 1:13:46]: has been addressed on there are they saying it's already been addressed or going to be addressed? Anything that's been said here tonight? [1:13:47, 1:13:51]: Mm. Uh there are a number of things with respect to the the clubhouse and the pool. [1:13:51, 1:13:54]: In the development agreement, because that's what we can govern. [1:13:54, 1:14:00]: based on the development agreement that they have uh said that they have already addressed. There are items that are still outstanding. [1:14:00, 1:14:20]: And again, we'll have to confirm all of that and look at all of that. I mean, I went out uh I was out there at the property today because I just wanted to take a look at it, that in another property. Um, and um there was acti well, I shouldn't say activity. There were things in the clubhouse when you looked in that gave the impression that there was some things that were being done that was cosmetic. When that was done, I don't know. [1:14:21, 1:14:25]: will have to confirm everything that they've said that they have done thus far. [1:14:25, 1:14:45]: And then the things that are outstanding they say they'll do and complete by the end of the week, which we'll have to obviously confirm as well. Yeah, but as a follow-up, but my question still stands once we stepped into negotiations with the new developer pertaining to what needed to be done on site. [1:14:45, 1:14:54]: pertaining to their amenities. Once we entered that to that and we had a contractual agreement, then it becomes a part of the city's responsibility now. [1:14:55, 1:15:15]: Those those things which we can't that are part of the agreement, yes. Those things that are part of the agreement. Then are we communicating with somebody in the community about that? Because I think the lack of communication is really what's going on here. That we they don't know what we're doing and I obviously don't know what's what's actually going on unless there's some type of communication going on. So [1:15:15, 1:15:17]: But whatever we need to do to open that, open that door. [1:15:18, 1:15:25]: All right. Stand by okay. Miss Rob Ms. Robinson. Yes. Go ahead. Um I just want the legal [1:15:26, 1:15:36]: to state to the community so they won't think that I'm just throwing stuff in your mouth what you stated to me so that way we can have everybody at the table. Your suggestion, please, sir. [1:15:39, 1:15:47]: If you are referring to a meeting that the city facilitated with the community and the various parties, [1:15:47, 1:15:52]: That was one of the early recommendations that we try to facilitate a meeting. [1:15:52, 1:15:56]: So they would know who to talk to, where to go, so they might. [1:15:57, 1:16:00]: Here a real timeline for when [1:16:00, 1:16:02]: control the homeow homeowners association. [1:16:03, 1:16:07]: might go to the residence that we won't be here. [1:16:07, 1:16:08]: Trying to [1:16:08, 1:16:13]: you know, cite a a corporate entity in New Jersey we w to deal with [1:16:13, 1:16:16]: code enforcement issues. And and just to clarify [1:16:16, 1:16:18]: What I was trying to say earlier is [1:16:18, 1:16:21]: Again, a lot of the complaints about billing and [1:16:21, 1:16:23]: Liens and all these sorts. [1:16:23, 1:16:26]: Those are private aspects of the management of [1:16:27, 1:16:36]: the amenities that we have no control over. We do have the ability to make sure that they're up to code, but how they're managed is completely out of [1:16:36, 1:16:42]: the city's control but what we can do or what what was suggested is that we try to facilitate [1:16:43, 1:16:46]: Those conversations so that in the future. [1:16:46, 1:16:49]: They would have the ability to control their own destiny. [1:16:50, 1:16:58]: Thank you, Mayor. With the follow-up to that, I just wanted to state that to everyone. So when I stood at the podium, that's the process that we had going. [1:16:58, 1:17:05]: legal just like he stated, he w he was gonna have them where we can communicate. That was halted. [1:17:05, 1:17:09]: So I just wanna make it clear so it w everybody won't they could understand. [1:17:10, 1:17:23]: The city w was trying to communicate, but that was halted. So I just want to make that clear. Okay. Sta stand by please. Okay, Miss does it uh go ahead now, Councilman. Yes, can we have Ms. Moore come back to the podium, please? [1:17:24, 1:17:24]: Miss Moore. [1:17:31, 1:17:51]: I just want to get real specific. The city attorney has already said has said that we're going to get an answer on a number of these items uh in by the next meeting or the next time. I want timetables on all of this. Now you indicated that you were gonna go out personally tomorrow and respond. Is there a point of contact that these residents [1:17:51, 1:17:58]: Can understand to get that information so they know the result uh of that visit. [1:17:59, 1:18:19]: Uh if they want to tonight leave a point of contact, uh I'll be more than happy to give them that information for them to disseminate. Absolutely. And my second question is so everybody understands we're talking about Pine View and we're talking about Pine Grove. Now the residents have stated that they were building houses. [1:18:19, 1:18:39]: in Pine Grove at this point. The agreement that was reached by the city, and maybe the attorney can speak to this, they can't build any new houses in Pine View. But they have they are going to be able to still build houses in Pine Grove. So folks don't understand that they're building, there's built-I just want to make sure that the agreement that is already [1:18:39, 1:18:59]: In hand is that it does not stop them. I just want to make sure the folks understand that before they leave, so when another house goes up, right? That you're talking about they can't build any house in Pine View. Is that correct? I'm gonna let the statement speaks to Pine View, the new development which is on the other side of the railroad tracks. So as things currently stand and [1:18:59, 1:19:03]: Unless additional code violations are cited against. [1:19:03, 1:19:23]: the current builder Silverstone, they can continue to build. Silverstone can let me explain why, a councilman. The the reason why Silverstone sued the city was because we did a stop work order. Right. Their argument before the court was that they only came in and bought the remaining lots that were left in Pine Grove. [1:19:23, 1:19:43]: And the judge appeared to have listened to that and rather than give a decision, he said y'all work it out. And basically what we got worked maybe not Mike. That's not correct. The judge was m more favorable to the city. So I don't wanna go into the weeds on everything that was said in court, but [1:19:43, 1:19:45]: А the judge was more favorable to the city. [1:19:45, 1:19:51]: and was was about to dismiss it in our favor, but he wanted us to try to work it out. [1:19:52, 1:19:54]: Биказ овіши, пізде, джадж андерстуд. [1:19:55, 1:19:57]: that the real party that control [1:19:58, 1:20:18]: what was going on in terms of the money that's going into the homeowners association, et cetera, was Rialto, not Silverstone. So that's why he wanted us to work it out. But Silverstone, your question was whether or not Silverstone could continue to build. My point was Silverstone position was we just bought the lots. Absolutely. I just want to make sure that we [1:20:17, 1:20:37]: Get answers and that after your visit tomorrow, that this community is going to be informed, and there's a that they set up some mechanism even inside themselves to know who the point of contact is. So when the message, I don't know if that's Councilwoman Robinson or whoever that may be, that this information is disseminated so everybody knows. [1:20:37, 1:20:51]: knows what's going on. I want timelines like we've just thought about, we just talked about, and that we can come back. There's a built-in follow-up that this doesn't go weeks without being revisited. And that's that's what we're gonna do, right, Mr. Williams? [1:20:53, 1:21:13]: Well what we would do is the citation list of code compliance, whoever the contact is, we can mail them the list of code violations and give them an update on the status of those being brought into compliance. Sit down, have a sit down, sir. Have a sit down, please. Go right ahead. [1:21:13, 1:21:20]: Madam Clerks. I just need a clarification that Silverstone is able to build in which one? Pine View or Pine Grove? [1:21:20, 1:21:22]: They can continue to build in [1:21:24, 1:21:25]: Pangrove. [1:21:26, 1:21:35]: Thank you. All right. Go write it, please. That's how it is. I'm just going to do that. Real quick I wanted you to know it. The contract agreement is between whom? [1:21:37, 1:21:47]: The city of Stockbridge and Draypak, which is the developer for Pine View. Okay. They agreed that the that [1:21:47, 1:21:50]: Their position was they had nothing to do with this. [1:21:50, 1:22:03]: But they wanted to move forward on their development. So in exchange for being able to move forward on their development, they agreed to pay for the uh the cost of bringing these amenities up the code. [1:22:03, 1:22:23]: Okay. So when we found out that the amenities were not up to code and after citing, the city of Stockbridge had an agreement put in place that Draco has Drack. Drake Dray Pack has signed Draco Harry Potter. But Drapack has signed [1:22:23, 1:22:43]: Right, that basically says that we can't that a city says you can't build until you get these things done. You contacted them today to see where we are because we found out that we were gonna have a crowd that wanted to know where we stood. You contacted them today and they said that they are 90% [1:22:43, 1:22:48]: complete with all of the things that have that we have requested. [1:22:48, 1:23:08]: That's what they said. That's what they said. And so Mrs. Moore has now stated that she is going to go out tomorrow and make sure that all those things that are required for amenity purposes to see what ninety percent they have completed and the ten percent where their timeline is on getting the rest of [1:23:08, 1:23:17]: The things done. That's where we are, correct? The other homeowners associations or developers or whatever they were. [1:23:17, 1:23:18]: Do we know where they are? [1:23:21, 1:23:24]: One second, one second. One second. [1:23:25, 1:23:36]: So let me take it in pieces. So there are two developers, Silverstone and Draypack. We know exactly where Silverstone is. We know exactly where Draypack is. [1:23:37, 1:23:52]: The the original. The the pre the original. The ones that are responsible for when these when these are these are the actual builders. Okay. The biggest problem isn't the builders as much as it is Rialto because Rialto [1:23:52, 1:23:56]: has access to all the money that's going into the homeowners association. [1:23:57, 1:24:02]: Ріато і компанія hired the management company. [1:24:02, 1:24:03]: that the residents can't [1:24:04, 1:24:04]: seem to [1:24:05, 1:24:06]: Fine. [1:24:07, 1:24:07]: And so [1:24:07, 1:24:08]: We know [1:24:09, 1:24:27]: where Rialto is, the problem is they're up in New Jersey or wherever. And they they don't respond to the city. Um and so we that's why we have leveraged uh tr going after the developers. Okay. All right. Thank you. So you're saying that they did not respond to the city, Rialto. [1:24:27, 1:24:47]: Correct. Correct. They did not everyone hears that. So uh and not only did we go a step and above and beyond the call of duty for the city of Stockbridge, but we are also we also tried to bring everyone together. That's not true. And they there was not our c our city attorney just made the statement. [1:24:47, 1:24:50]: Now we have an agreement to get those amen amenities. [1:24:50, 1:25:10]: fixed. So that's where we are as a council. And those are questions and clarification that I wanted. But um I would love to speak to some of you um later in regards to some of your issues. Uh mayor. Yeah one second please. Did you have anything else you need to say? Well to go right here if you do sir. Go ahead. [1:25:11, 1:25:23]: I I know there are some other questions and I I just wanna thank Mrs. Moore and Councilwoman Gantt for some clarification. But the reason I raise my hand, I wanna yield to [1:25:23, 1:25:32]: Mr. May, I want to yield to two citizens. I know this gentleman has been wanting to say something for a while. It's your prerogative to to allow that. Um [1:25:32, 1:25:35]: Oh okay. Hold hold on one minute, miss. Hold on. [1:25:36, 1:25:42]: But but again I I it's becoming clear and I hope y'all can see the same picture that I'm seeing. [1:25:42, 1:25:45]: That some of these things [1:25:45, 1:25:47]: We have no control over. [1:25:48, 1:25:56]: Some of these things that you do as far as your relationship with the hormones association and Rialto. [1:25:57, 1:26:02]: Okay, do we we uh ho ho ho hold on hold on. But we understand this, right? So there's [1:26:04, 1:26:05]: So [1:26:07, 1:26:15]: Mayor. Stand by. Let me let me can k let let them go ahead and finish your comments, sir. Okay. Uh uh well I'm I'm [1:26:16, 1:26:22]: I know I can't interface and interact with you just like this, but I'm just trying to make it clear. [1:26:22, 1:26:30]: On the city responsibility and what we're going to do. Mrs. Moore has indicated that she's going out tomorrow. [1:26:30, 1:26:45]: Code enforcement is going out tomorrow. The city attorney has made some things clear on who's responsibility. Now I may I made mention to the Homeowns Association and what [1:26:45, 1:26:51]: What needs to happen there, which we have no responsibility. But I think you're trying to say that we do have some [1:26:52, 1:27:07]: obligation to the Homeowners Association. So I'm just trying to just clear the plan field. So when we leave here tomorrow, everyone knows what their responsibilities are and and something is going forward. Again, I'm about results. [1:27:08, 1:27:16]: Mrs. Moore's going out tomorrow. Code enforcement is going out tomorrow. So you got to allow that process to take place. [1:27:17, 1:27:37]: Okay, so I'm gonna turn it back to the mayor. Only the mayor can recognize your hand. I can't recognize your hand. Okay, I'm gonna tell you what. Based on your recommendation, two more individuals. Sir, you it must be the second time you've actually spoken, actually, correct? You never spoke. I'm sorry, something come on. Maybe the lady. I'll I'll get him, I'll get him a bit. Go re name name and address. My name's I'll find [1:27:37, 1:27:42]: Yes, it's under m under Melissa Parsons. [1:27:47, 1:27:52]: Yeah. Go right in. Okay, my address is sixteen seventy-six Gallup Drive. Okay. [1:27:53, 1:27:55]: I have a concern that [1:27:56, 1:28:07]: knowing business and so forth, in order for all of these companies that we're mentioning, that we're saying, they've got to have some kind of operating permit from the state of I mean from the city of Stockbridge, right? [1:28:08, 1:28:13]: Right. Right. And you all see how dysfunctional that this is. [1:28:14, 1:28:21]: You all can't just cease and desist or remove their operating permits until this right here gets resolved. [1:28:22, 1:28:40]: Yeah, we well we can do that. I can let the city manager or or the uh city manager deal with cause they deal with they have oversight of that. But the answer the answer should be yes. But go right ahead, but Okay, now if that can be done, we see everyone more than seventy percent of the people in here is because of the dysfunctional things that's taking place in Pine Grove. [1:28:40, 1:28:43]: And now I'm hearing this thing about Pine View. [1:28:43, 1:28:44]: That's a scary thought. [1:28:45, 1:28:47]: If you take [1:28:47, 1:28:50]: Okay, my reason for being up here really is [1:28:50, 1:28:51]: We're in court. [1:28:52, 1:29:01]: No one talked about the court, the attorney fees, and having to pay for amenities that we have not been able to use. [1:29:02, 1:29:09]: And here it is, we had like a forty-four, forty five hundred dollar bill. Maybe two thousand of it is for attorney fees. [1:29:10, 1:29:10]: But [1:29:11, 1:29:17]: On our um, I think when we first signed the move in the house, they had where [1:29:18, 1:29:20]: We pay we moved in in tu taus na. [1:29:21, 1:29:25]: And they had something for two thousand eight assessed against us already. [1:29:25, 1:29:34]: And we weren't even residents. Right. And I'm kind of confused as to what all is being said now because is it that [1:29:35, 1:29:53]: Uh you're you're trying to bring things up to code so a new developer can come in and build houses because we haven't had access to any of the amenities in like four or five years. Our issue is we do not have a pool. [1:29:54, 1:29:58]: Tennis court club house that we [1:29:58, 1:30:10]: That's what the HOA is all about. Why are we being taken to court to pay for something that we do not have? We're not concerned with Pine View. [1:30:11, 1:30:31]: We're concerned with Pine Grove. They're suing us, and we do not have any of the amenities. And that's not right. But that's right. We don't care about coming up to code so Pine View can come in and bill. People that just moved in there a year or two ago, why are they being assessed$800 and we have nothing? [1:30:31, 1:30:36]: Nothing. So they're bringing things up to code so a new developer can come in. [1:30:36, 1:30:39]: You gonna clean the pool for new people? [1:30:39, 1:30:57]: But the people that have been living there and the new people that just moved there, swimming swimming uh community, tennis court, flies, none of that. We are here about fees and being sued for stuff that we do not have. Okay, step step. [1:30:58, 1:31:18]: Okay. Hold on. What it amounts to, I would think, now I gotta turn it here, those things seem like to be things that you have to deal with uh personally in reference to the HOA as aspect itself. But what's happening is the system [1:31:18, 1:31:38]: Allowing these people to still function. And you're hearing if if I ran a business in Stockbridge. Okay, if I ran a business in Stockbridge that was misleading and not providing to the people what they gave me the money for, you always shut me down. Okay. You always shut me down. Now, these are businesses, these are not. [1:31:38, 1:31:47]: Okay. [1:31:48, 1:31:51]: Well uh association is just all [1:31:51, 1:31:52]: They are [1:31:53, 1:32:08]: Okay, understand. Okay, okay, ma'am. Go could you is anything else to reference his concerns about these passed the lawsuit and he's passed through HY fees and things of this nature. Is there anything else you can add that hasn't already been mentioned? No sir. Oh context. Go ahead. Can you anything else? [1:32:10, 1:32:13]: Okay. Nothing else you can add in reference. Anything else you can add about that? [1:32:14, 1:32:27]: At all. Man. No one look no one seems to know the answers. Okay. And that's not right, man. Okay. We're here. We voted you all in. I understand it. We all voted you all in. Understand it. All right. [1:32:27, 1:32:29]: Right. [1:32:29, 1:32:49]: Uh we we got we gotta know this on tape, we gotta know to that. We'll s we'll s we'll do what we can as a city. Some things are are dealt with. Cold code enforcement. Right. Yes. I live at sixteen seventy six. Somebody please jot this down. Sixteen seventy six. Sixteen seventy six Gallup Drive. Okay. I have a retention pond. [1:32:49, 1:32:50]: Yeah. [1:32:50, 1:33:10]: That's behind my um security fence. Right. And the bushes is up to the ceiling, man. Okay. All right. We'll take a look at that. See, see what we're gonna solve, solve that problem. Okay. Okay. Now, when and another thing, since I'm up here with Mike. Yeah. Yeah. Now every year pass your time. Okay, every every year or twice a year, we have [1:33:10, 1:33:12]: We have a major car break in. [1:33:13, 1:33:20]: Now if somebody wants to talk about something, that doesn't please the police presence. We need more police presence. Okay, what what what it [1:33:21, 1:33:41]: Okay. We'll talk we'll deal with that. We'll have to talk to the uh gotta call the police about that, okay as well. Okay. All right. Now, listen, that that's it sir for you for right now. Uh we got we got it. We got note, okay? One more. Timeout. Who are you, man? I let's see. I was gonna I was have this gentleman talk. I was gonna get two people to talk. Very short. [1:33:41, 1:33:50]: I'll bet you comments probably no more. No, no, sir. I said I'm gonna be very short, and that's what I said. My name is Maddie Simpkins. I'm at 16 uh [1:33:53, 1:34:08]: Yep, that's the gentleman I wanted to talk. Did you do yep, I wanted this gentleman talking. Can I go after him? Uh well, I don't know, did you fill out a form? I did, sir. And she already had my name and everything. [1:34:08, 1:34:13]: No, but I can't let everybody can't speak tonight. We we've already been a good hour into this. [1:34:14, 1:34:16]: Could you put let the stelma speak, please? [1:34:18, 1:34:25]: Yeah, yeah. Yep. [1:34:28, 1:34:31]: Corre uh you said? Wait a minute, you gotta restart that. Okay, so [1:34:32, 1:34:34]: Okay, go write it. Name and address, please. [1:34:34, 1:34:47]: Tyrone uh good evening, Mayor. Good evening. Uh Tyrone Hardy, 204 Baltimore Avenue. Um, this isn't just a new thing that's been going on. I moved at that residence in 2005. [1:34:48, 1:34:50]: Since two thousand five it has been terrible. [1:34:51, 1:34:52]: It's the same thing. [1:34:52, 1:35:12]: The uh it changes builder to builder to builder. When you try to talk to the homeowners association people, they would not allow you to form a committee. They sent my wife a deceased and assist order saying, Hey, you can't do that. You need to stop. So this thing of it's not it's more than a clubhouse. It's more than somebody's [1:35:12, 1:35:30]: you know, not cutting their grass. It's about bringing the community together so that the people can have access to it. They're saying, oh well, when X amount of number of houses get sold, then you will have access to it. So when are we going to get to that X amount? As far as I can see it now, we almost 100% sold out there. [1:35:31, 1:35:48]: We well, we well over the number of amount that they're asking about. So the other thing that I'm I'm I'm trying to figure out is when the city stepped in and started voicing their opinion for us, you guys, just like you you just admitted, Mr. John, you guys entered into a contract representing us. Am I correct? [1:35:49, 1:36:04]: You guys represent y'all y'all started representing us in that contract and speaking for us. So my question is, who thought it was a bright ideal to put Pine View in and there's nothing but blank land over there? [1:36:05, 1:36:15]: Hell that excuse me, that that builder can sell that property tomorrow and walk away and sell it to the next man and start building. All he's gonna do is quick claim deed that stuff to his friend. [1:36:15, 1:36:17]: And still make money over money. [1:36:18, 1:36:38]: And and let me say this real quick. With results, this is what I want,'cause I'm a teacher, I'm in layman's terms. I need everybody who's involved. I need a name, a number, and an email. So when the man with the mosquitoes, he needs to know who to call. When my child says she wanna go to the pool and and nobody the pool can't open, I need to know who to call and nag and get those. [1:36:38, 1:36:58]: Results. There needs to be a system of accountability as well. Because you can call down there and say, Okay, I want this done, but if they don't do it, then how do we know they're not doing? I don't like to do a lot of tongue wrestling. That's ridiculous to me. We left it, we're gonna leave, and a lot of people, just like you said, we're gonna leave discouraged and everything else, like and ain't gonna do nothing. But at the end of the day, [1:36:58, 1:37:05]: If you can have in black and white, what uh who is responsible for what? Everybody on the council. [1:37:06, 1:37:13]: These these men right here. And sometimes I'm just gonna say this real quick. You know who got stake who got some skin in the game. [1:37:13, 1:37:23]: That's just the bottom line. I don't like a laid-back attitude when it comes to where we live and all these people right here. And it's like, oh, it's gonna take three or four, you three or four um pages. You already knew what we were coming for. [1:37:24, 1:37:25]: That's just simple as that. [1:37:26, 1:37:28]: So you should already have that stuff ready to go. [1:37:28, 1:37:37]: Bottom line. And I will say this much right here. You said it. Somebody just said it. Guess what? We voted y'all leave. Bottom line. And you can be voted out. [1:37:37, 1:37:57]: So thank you, Ms. Robinson, our preachers. Thank you. I appreciate you for speaking up for us as well. Okay. Thank you. Thank you. What one second. This let's last slide. You're the last one, cause folks we're gonna have to move out. We got we got the gest of this issue. I'm pretty sure we got the jest here. No, no, no. I just can't keep running. We w no you come on. Come on. Come on. Come on. Name it after uh [1:37:57, 1:38:14]: You have uh you got the form? Name and address, please. I I'm not gonna take long at all. Uh I've heard Maddie Simpkins, um, seventeen oh one Gallup Drive, Stockbridge, Georgia. Okay. We have been at the meetings, uh, me and a c uh three or four of the neighbors in our neighborhood, um, to, you know [1:38:14, 1:38:30]: to to find out what's going on and whatnot. And I've heard a lot of things what the people are saying here. We need the information from the people that we need to contact. We don't need to make it your responsibility because there is some part that you all take place in. I would like to see you shut all of it down. And then to the people. [1:38:30, 1:38:42]: We need to get an attorney. Stop talking to them. They can't do certain part of this for us. You need to get an attorney. Stop it right there. Come together as a people. And I'm done. All right. Thank you very much. Okay, on that note. [1:38:43, 1:39:03]: On that note, on that note, folks, uh you stay as long as you like for it's a public meeting. We're gonna cut this particular conversation on move on with the rest of the meeting. The council has heard your wishes, heard your thoughts. Our city attorney, along with city manager, our assistant city manager has got all that. We have updates on this continually. And you have a representative on the council that is in your community. Yes, ma'am. What else can you say? [1:39:03, 1:39:18]: There are three other public comments on another matter. Okay. Yeah, there are three other people that wrote they're not about this issue. What are what's the friends? Mr Tyrone Smith. Tyrone Smith? [1:39:18, 1:39:31]: Valerie Cohn I'm sorry, Qui I think it is. Okay, there we go. And Ronel Malik Salters Esquire. Okay. So Mr. Tyrone Smith, right? [1:39:32, 1:39:36]: Tyr is that Tyrone Smith Tyrone Smith. Mr Smith, Tyrone Smith, are you still here? Okay. Come on, sir. [1:39:43, 1:39:55]: My name is Tyrone Smith. My address is one fifteen Jans Meadows, Stockbridge. I'm a proud Henry County resident and I am in uh Stockbridge Unincorporated. [1:39:58, 1:40:18]: Go ahead, sir. Okay. Mr. Mayor and Council, uh, I am a recruiter with the United States Census, and I wanted to come before you to let you know that the Census is now hiring here in Henry County and in Stockbridge. My main purpose is to let you know that, to let your constituency [1:40:18, 1:40:22]: No, that we're paying fifty fifty an hour. [1:40:23, 1:40:35]: Full time. Stand by one second, please. Hey folks, if if you if you're going to depart, going to depart, we've still got a meeting going on. We want to make sure we uh we hear Mr. Smith here. Keep it keep it the low roar. Very low. Go right here, sir. Continue on. [1:40:35, 1:40:55]: Like I said, we're paying$15.50 an hour, full-time, part-time. Uh my uh other reason is twofold because not only are we hiring, but the census count is coming. 2020, April 1st, 2020 is census day, and it is very important that everyone [1:40:55, 1:40:56]: One. [1:40:57, 1:41:17]: uh who has a household who lives here in henry county get counted. If I can get people hired, then the people that are that are hired can let others know that they have to be counted. It is so important. It is as as as important as the vote. If we do [1:41:17, 1:41:35]: Do not do anything as far as getting our people counted. There's it's something like six hundred and seventy-five billion dollars that our federal government pumps down into the fifty states. And it is up to us as uh as citizens of this great [1:41:35, 1:41:45]: state and this great county to get counted so that money can come to us. Is money going to other places if we do not get our count properly done? [1:41:46, 1:42:06]: Uh are there any other questions for me? Let me ask you this. Uh in reference to this and this gentleman here, is there something that he needs to do with the full time staff or you know, the council will get a chance to ask a question in a second. In reference to you all, uh in reference to what he's what he's doing in front of the census count, anything like that? Job fair. One second please. If it's related to the census count. [1:42:06, 1:42:13]: itself, then certainly we want to have as much information as we can to disseminate to uh all of the citizens of Stockbridge and beyond. [1:42:14, 1:42:23]: Um obviously in terms of uh the gentleman uh providing uh hiring opportunities, that's you know something that's really beyond our specific purview, but in terms of the census [1:42:23, 1:42:26]: We certainly want to make sure that it's highlighted in people. [1:42:26, 1:42:28]: are fully aware of that it's coming. [1:42:28, 1:42:31]: And they will participate uh in the census count. [1:42:32, 1:42:52]: All right. Uh in reference to qu in reference to questions for Mr. Smith here. Any council have any questions here? Yes. Go right go right. One second. Go ahead. Yeah, quick question. How you doing is the Zena? Yes, sir. How you doing? Uh I'm doing well. Uh if in any citizens that wants to get involved with this, how do they get involved? How do they is there a uh email? [1:42:52, 1:43:12]: or there's a website or something. How do they get involved? Yes, uh the and I have information for you and I I have it electronically. I can easily send it to you and I have information with me. But to get involved as far as getting hired by the census they go to the website as 2020census.gov. [1:43:12, 1:43:24]: slash jobs, J O B S. That's the way everyone applies for positions with the United States Census as far as the 2020 uh decennial census is concerned. [1:43:25, 1:43:34]: Again, it's 2020 census.gov G-O-V slash jobs J-O-B-S. [1:43:34, 1:43:35]: Mm. All right. [1:43:35, 1:43:55]: Thank you. Any other questions for Mr. Ces sir. Now I'm very interested in uh we have a job fair coming up on June twentieth. It would be a great opportunity for you to come and then maybe even set up a table. There's no charge to talk about the census and even have the job oper let everybody know uh about those jobs. [1:43:55, 1:44:15]: Opportunities uh that are available. So it's on June 20th. That's something that we have. Uh you're more than welcome to come and join us to get this out there. I would definitely like to be there. I just have to check my my schedule to make sure I'm not somewhere else. Uh as far as job fairs, I conduct job fairs once a month uh at [1:44:15, 1:44:35]: Your Department of Labor. I do it at the one in uh Griffin right now, but I am all I'm in the system as far as the Department of Labors are concerned. So I can conduct a job fair at any Department of Labor here in the state of Georgia because I'm already in the system. So I do it in uh Baldwin County and I do it in Oscar. [1:44:35, 1:44:38]: Falding County and would love to do it right here in Henry County. [1:44:39, 1:44:59]: Okay. I'll email him our flyer. Okay. Any other questions down here? Go ahead. Yes ma'am. What is the age requirement for jobs for for for that? I'll answer your question about I'm gonna go further. I have an information sheet now make sure I you get that so [1:44:59, 1:45:19]: You'll have everything. Age requirement: you must be at least 18 years of age, have a social security number, have an email address. If you're a male born after 1959, you have to have uh selective been put in for the selective service, in other words, apply for the draft. Um that's pretty in the United States. [1:45:19, 1:45:32]: state citizen. But I it's a it's there are other things that are involved in it, but that's the basic thing. You have to have those things. And as long as you're good to go there, as soon as you do your application, it will say your application is complete. [1:45:32, 1:45:49]: Okay. Thank you. Any other questions down here for this gentleman? Okay. Thank you, Miss Smith. I really appreciate it. Look forward to seeing you at at a job fair, you know, recruiting this aspect or even meeting with our staff, okay? Thank you. Thank you, sir. Who's next? Um Miss Valerie Comb. I don't want to miss it. Valerie? [1:45:52, 1:45:55]: Yeah yeah, come on, come on up, ma'am. [1:45:55, 1:45:56]: Members of the council. [1:46:00, 1:46:12]: Such a pleasure to be in Statbridge this afternoon. I'm a resident of DeCal County, a real estate broker for my own company, all in one international reality group. [1:46:14, 1:46:14]: Oh [1:46:16, 1:46:19]: I sat here all evening and I digest everything. [1:46:20, 1:46:40]: You guys have your hands full, but you can handle it. I have confidence that you all can handle it. You're fine, ladies and gentlemen. Now I'm here to um talk on behalf of Miss Jackie Kennedy. I um was the selling broker of a property here in Stockton. Okay, okay. [1:46:40, 1:46:55]: Yeah good point. Uh we actually have you on the agenda uh anyway. You're coming on the you're actually on the agenda next after public comment. After any after public comments. So we'll we'll just wait a little bit. Let's there's another person. We'll we'll get to you. You're you're on the agenda. You'll get to you. [1:46:55, 1:47:02]: They're they're both the same. Oh, they're both the same? Yeah. That's under the there'll be a public hearing under that item. [1:47:02, 1:47:22]: Oh, okay. Okay. So this actually ends public comments and we actually go on to the appeal hearing is what it amounts to. On a on appeal hearing it's not it's a it's not open to the public. I mean it's open to the public, but I don't have to get public comment. It's just one on one basically in a sense. I think it's a one and one. Yes. Yes. So I I don't even think I'm supposed to speak first. Okay, what what standby. [1:47:22, 1:47:42]: So this is this is an appeal hearing. Applicant Jacqueline Kennedy, Kennedy Events LLC, and nature requests denial of business permit. Location is one one one four West Burke Street, proposed use as event center, a reason for denial, moratorium in place for assembly uses. And it actually has Camilla Moore on here. [1:47:42, 1:47:55]: here. I know you can present, but has Camilla Moore on here as a presenter. And obviously this is this is a pill process that the council at previously previous meeting meeting asked for you to come forward and have this uh go through this process and have this discussion with us. Go right ahead, sir. [1:47:55, 1:48:05]: Yes, sir. I just wanted to clarify procedurally where we are. Okay. This is a request to be exempted from the moratorium. Okay. So if [1:48:05, 1:48:14]: you all decide to exempt her from the moratorium, all that she would be able to do would be able to submit an application [1:48:14, 1:48:21]: Um so granting the exemption does not automatically grant the the business license. [1:48:21, 1:48:33]: It just allows them to go ahead and apply and they would otherwise have to meet all the other portions of the city's codes. Okay. Miss thank you. Miss Moore, this we're now in the appeal process. What else what else do you have to add to this ma'am? [1:48:34, 1:48:54]: Oh uh nothing. Uh whatever the mayor and council wants to do. We haven't we haven't discussed it. We haven't got a full but he has you on presenter. So mister Mr. Williams has already spoke. Okay. Go ahead. This is an appeal process. Okay. Uh she's sending her application today. I think she's uh giving you her reasons as to why she wants the exemption and whatever. [1:48:53, 1:49:13]: Whatever is the will is the mayor council, staff will abide. All right. Thank you, ma'am. Now on that note, yes, you would go ahead you go ahead. Go ahead with uh with your comments. And you initially started opening your comments about this, so you now have the process to appeal to the Okay Mayor. This is the actual applicant right here. [1:49:13, 1:49:33]: Right. Well she came up and said she was speaking and on her b behalf, I thought. On her behalf, okay. She's a real estate uh you're a real you're a real estate agent, I believe, right? Okay, okay. Right. Um so she's she's actually bringing economic development to the city of Stock. Okay. And in my opinion, I'm saying if one is bringing [1:49:33, 1:49:37]: economic development in the city, it's a great thing. [1:49:37, 1:49:39]: However, um [1:49:40, 1:50:00]: She bought the property. She did her due diligence because before I submitted the contract to the seller, I told I instructed Miss Kennedy to do her due diligence in calling the city of Stockbridge, talking to the council, you know, the plan and zoning. Planning zoning. You spoke to the city attorney. [1:50:00, 1:50:17]: No, so that's after. Yeah. But prior to. I did call the planning and zoning before I purchased the property to tell them what I'm gonna the property address, what I'm gonna use it for. I say I'm gonna use it for an event center. Can you tell me if it's zone as such and can I go ahead? [1:50:17, 1:50:20]: And use it for event center. Well, so yes, go ahead. [1:50:20, 1:50:23]: Once you purchase the property, you just need to come in. [1:50:23, 1:50:25]: and apply for a permit. [1:50:25, 1:50:27]: So I went ahead. [1:50:28, 1:50:30]: So I I don't know about [1:50:30, 1:50:37]: And moratorium was never told to me until way after the fact because I don't know anything about properties. I the first time I heard mortorium. [1:50:37, 1:50:39]: was when it was sent to me in an email. [1:50:40, 1:50:57]: After I purchased the property the day after, I went back to Plan and Zone again, cause I did not know where to apply for the permit. I went to Plan and Zone, I spent about an hour and a half in the office. They looked through all their um permitted use, whatever they call it, and they say, okay, fine, go ahead. [1:50:57, 1:51:03]: Go submit your application over to the business office. I came and I sat down with Miss Yunida. [1:51:03, 1:51:05]: And I filled out the temple all I needed. [1:51:05, 1:51:08]: And I was able to fully and I even draft. I'm not a very [1:51:08, 1:51:11]: Cra uh artist person had to draw to build in on everything. [1:51:12, 1:51:14]: And submitted my paper. She told me okay. [1:51:14, 1:51:17]: It takes about three to four weeks, but in five days [1:51:17, 1:51:20]: They're gonna have to send it back to Plan Nanzone once it's approved by them. [1:51:21, 1:51:22]: Then they will [1:51:22, 1:51:23]: Push forward. [1:51:24, 1:51:28]: I didn't hear from her in five days. I give her a couple more days. Then I came back to the office again. [1:51:29, 1:51:31]: They said they didn't urge from planning yet. [1:51:31, 1:51:35]: And I think there was a time they had gone on some retreat or some meeting and [1:51:35, 1:51:36]: There was something going on. [1:51:36, 1:51:56]: So the following day I got an email saying unfortunately was denied because of the moratorium. Now I was confused because I have no idea. Nobody told me. I I was saying if you told me, yes, it's zoned for such, but we have a moratorium where we cannot give a permit. I wouldn't have bought the property. She would not purchase it. And she paid. I took all my little uh money. [1:51:56, 1:51:58]: [6718.6, 6724.9]: for my for my retirement to pay down on this property because it's it wasn't cheap. [1:52:05, 1:52:15]: Right, I paid on on this property, which if I had known I would not. Then I started, you know, doing stuff, buying stuff, because it's gonna be an event center. So I started buying stuff. [1:52:15, 1:52:35]: But uh in my opinion she was misinformed and that's not nice. Because she called. She did due diligence, which is what the what I should educationally provide her with that information that you need to do your due due diligence. You have ten days. She did her due diligence, called me back and [1:52:35, 1:52:48]: said, Miss Conque, go ahead with the contract. City of Stockbridge said the use is permitted for that location. Then after she bought it, bam. And then even though I called, I tried. [1:52:48, 1:53:08]: Yes. Okay. So I did follow through. We you know when all those broadbacks, um, Miss You need uh um gave me the city manager and city attorney number to call. I couldn't get through to them. I gave it to my realtor, we still couldn't get through. Then I was, you know, get in contact with Mr. Thomas. [1:53:08, 1:53:18]: Spoke to Mr Thomas. He said he's not sure if the the event centre fall under assembly use, but he will contact the city manager and the city attorney. [1:53:19, 1:53:39]: Uh um they call me, the city manager called me with the city attorney on the line about a week or so later. And the city attorney said, When you look at the paper, he doesn't think he said, not doesn't, he said the event center does not fall under assembly use, so I can go ahead and do my application. I said I've already put [1:53:39, 1:53:48]: Put in my application, I just need you to call the business office so that they can go ahead and push it through. He said, Okay, everything will be okay, fine. [1:53:48, 1:53:51]: I didn't hear from the business office about another week. [1:53:51, 1:53:54]: I went there, Miss Unida said, I still have not heard. [1:53:55, 1:53:57]: From anybody in Council and I cannot do anything. [1:53:57, 1:54:00]: Until I hear from someone in council. [1:54:00, 1:54:01]: So [1:54:02, 1:54:07]: I said I told her about my conversation. Okay, I'm gonna go and talk. So she went upstairs. [1:54:07, 1:54:10]: The Miss Camila came down with her. [1:54:10, 1:54:12]: А чи темі у [1:54:12, 1:54:20]: It does fall under assembly use. I told her my conversation, she said they want they apologi they won't apologize to me because that was apparently misinformation. [1:54:21, 1:54:41]: I say, you know, it's just for me, I just think that wasn't fair. That's when I reached out to the mayor as well. But by that time, I guess they had already organized for me to come in. I don't know if you remember, Mr. Mayor, you did call me back. I called you back. Thank you so much, and I thank you all. But I'm just saying right now I'm put in a position which I would not be in if I had given the proper [1:54:41, 1:54:59]: Proper information to start with. Because if this is public notice, plan and zoning, when I call, they should have added up to say, okay, when I'm researching, I would see oh there's a moratorium. Let the person know. I cannot know that. I don't know about moratorium. We are here to ask this afternoon. [1:55:00, 1:55:01]: Mr. Mayor? [1:55:01, 1:55:03]: Council members. [1:55:04, 1:55:05]: Give us an exemption. [1:55:05, 1:55:10]: It's it's economic development, it's growth, it's business but Stockbridge. Okay. [1:55:11, 1:55:16]: Thank you. Sir y I guess you want to something you need to add to this. I I do. Um [1:55:16, 1:55:27]: This is uh full disclosure, this is my mother in law and my wife. They purchased the bus they they purchased the building together and they started a business together. And um just procedurally I think um [1:55:28, 1:55:33]: Um in accordance with the resolution R nineteen ten thirty nine, right? [1:55:34, 1:55:54]: When you're done, you state your name. Okay. My name is Ronel Salters. I'm an attorney and I am um working with uh my mother-in-law and my my wife with regard to making sure that this uh situation gets cleared up. Okay. And again, in accordance with um R nineteen ten thirty-nine um and uh Canon v. Clayton County, I think. [1:55:54, 1:56:14]: that that we are in the place that we're supposed to be right now because um miss kennedy is a a a vested member or uh has vested rights with regards to this because she again has asked before she purchased the building someone in the city uh zoning department [1:56:13, 1:56:33]: Whether or not she was zoned for this property and the and the use that this business was gonna be used for. And they told her that she could use the business for what it was zoned for and that she could operate a business in the city of Stockbridge. So I think that that's the first thing. [1:56:33, 1:56:43]: that comes that that's important is that we're in accordance with the resolution and that she's a vested uh she has vested rights under this uh under this resolution. [1:56:44, 1:56:49]: Another thing is that that's difficult for us to understand is the um [1:56:49, 1:57:03]: assembly hall, right? Assembly use. The assembly use. So with every other um business that is in the resolution, it's very specific to what it is that you can and can't use a barbershop. [1:57:04, 1:57:05]: Tire shout. [1:57:06, 1:57:06]: Auto shop. [1:57:07, 1:57:10]: And then you get down to this last part which says assembly use. [1:57:11, 1:57:13]: Which is a kind of a catch all. [1:57:13, 1:57:14]: And [1:57:14, 1:57:34]: People that we've discussed this issue with, whether it be the city manager, the city attorney, or members of the council, is it's ambiguous as to what that actually means. We're running an event hall. Is that an assembly use? And if it is, why couldn't that be delineated in a resolution as well? [1:57:34, 1:57:38]: Well assembly and and uh delineate [1:57:39, 1:57:47]: The things that assembly use falls under because it's ambiguous. We don't know what it means. And it's gonna be difficult for somebody to kind of determine that without a definition for that. [1:57:48, 1:57:56]: Okay. That's all that I have. Mr. Mayor. Gentlemen, one second please. Gentlemen, in the reference to thus far the presentation, anything you need to add based on what they've said thus far? [1:57:57, 1:58:17]: Not yet. I'm sure we will have some. Okay. Councilman Alexander, go ahead, please. Yes, this is what I want to say to you all. As someone who um as long as Ms. Gann as well, who uh kind of crafted this uh with what the ordinance, my intention was not to involve someone like yourself. [1:58:17, 1:58:37]: uh which uh in this particular instance uh you own the property. Yes. You bought the property. Yes. The intent, my intent, I was speaking for myself, is that we didn't want storefront activities going on. You own this entire property, correct? Yes, yes. In its entirety. Yes. [1:58:37, 1:58:57]: You have a single use for this which is an event center. Yes. You have adequate parking. I yes, and I'm planning I just cut um paid almost a thousand dollars to cut out the bush and stuff to expand the parking so I won't be encroaching on anybody's property around the road. Right. But based on that alone and I [1:58:57, 1:59:17]: I think uh the appropriate thing to do is I'll make a motion to allow you to uh for this exemption to be um up uh uh approved. I make that motion because you own your single use. This is not a storefront, which was the intent of this particular exemption. I second thank you. You just seconded? Yeah, second. [1:59:17, 1:59:37]: Okay, further discussion. Yes. I'm sorry. No, no. Don't go right here. Go right to further discussion. Um My question is is is uh I wanna find out where the process went flawed because I the timelines are are jacked up and I'm I'm in agreement with my colleagues is that um [1:59:38, 1:59:43]: The intent of the mor memoriatorium was not to exclude um [1:59:45, 1:59:50]: this type of establishment. Um now at what point did you find out that [1:59:50, 1:59:55]: That was a moratorium. When uh Miss Unida sent me a denial letter. [1:59:55, 2:00:07]: This is bef after you've already applied and all the Yes.'Cause I'd appl I came to her and applied because as I said, I went to the zoning first, the af the day after. I closed on the thirtieth of April. [2:00:07, 2:00:12]: On the first of May I came back to the zoning, which they had already told me before I bought it. [2:00:12, 2:00:15]: But I wasn't sure where to apply for the permit. [2:00:15, 2:00:18]: So I went into the zoning office to find out where do I go. [2:00:19, 2:00:23]: I sat there for about hour and a half while they go through the C one, C two [2:00:23, 2:00:25]: Permitted use, because they brought the paper and [2:00:25, 2:00:26]: went through it with me. [2:00:27, 2:00:31]: And they said, Okay, I don't say anything would we deny you, so go ahead. [2:00:31, 2:00:37]: Go over to the business office and they told me where to go and go and submit. I came and spoke to Miss Unida. [2:00:37, 2:00:40]: Who was in the Africa, they told me specifically to go miss to Miss Unida. [2:00:41, 2:01:01]: And she told me exactly what I need. So I go ahead, fill out all the paper, give her all the documents that was required, and she tell me, you know, I'll get ear from that. I have a follow-up question, but I think Ms. Moore wants to say something. I have a follow-up question. I just want to go through the process and who does what. Uh Melinda Davies is the person that does zoning verifications. [2:01:01, 2:01:04]: And her role is just to verify the zoning. [2:01:04, 2:01:16]: not the use per se. In other words, her role should have been to tell her whether or not what uses can be utilized under C2, C one, C three. [2:01:17, 2:01:37]: That is where she should have stopped it. It's at that point when the person goes to the business license division and then actually asks for the use for a license which triggers something else. Does that make sense? In other words, at that point, um Yunita went to what's our [2:01:37, 2:01:56]: out there that would prevent the business license. So I put in a call to Melinda. Melinda apologized, but she says she never told her that she could um use it as an event center. She did tell her what was allowed in that commercial zoning. So that was um [2:01:57, 2:01:58]: I guess [2:01:58, 2:02:18]: I don't know how to say it. What I did tell Melinda that from now on, everything needs to be in writing. Does that make sense? A clear paper trail. So where we are, there's a ten day process from the time a person gets a zone of verification and then from that point they can go and actually ask for their business license. And then from that point then everything is put in motion. [2:02:18, 2:02:30]: Also with a follow up is that do you have you been notified on any contacts with the city on um what it would take to bring it up to code to operate? [2:02:30, 2:02:50]: No. No. They didn't tell me that it wasn't zone, so nobody tell me anything. No no no no. I'm sorry. What what I'm saying is that we we can facilitate you and let you know what it takes for your facility to bring it up to code. Right. Because you you at this point I don't think you have any idea what the expenses is. No. [2:02:50, 2:03:10]: I would ask that tonight that you would get Miss Moore's number so that she could set you up with the with with with the people to let you know on your property what it would that what it takes to get it up to code because I I I think that we ca we kinda dropped the ball a little bit on the phone. My permit is still I my permit is [2:03:09, 2:03:21]: still down in the business office. They still have that permit. They have an issue. So you guys have to move forward. That's fine. I'm gonna vote that we move forward, but I'm saying but I want you to to know [2:03:21, 2:03:41]: what financially you're getting into right to bring it up to code and we can help you facilitate that. So what happens should mayor and council approve for the exemption, then business license will issue a pending license that then triggers all of the assessment on the unit, which means then building [2:03:41, 2:03:54]: Everybody has to go out, look at the parking, look at the building and see what needs to happen in terms of a code related, and then we will tell her what the issues are in terms of bringing it up to code. Sure. [2:03:54, 2:03:55]: Thank you. [2:03:56, 2:04:08]: Ms. Gabb, go ahead. Well, I wanted to just make sure that planning and zoning and everyone has a list of our moratorium. We do. Um, so that in the future when someone contacts about [2:04:08, 2:04:13]: what we're zoned as that they also know and by the way, [2:04:14, 2:04:34]: There's a moratorium right now, just just because we say yes, C two, we just want to say no. And by the way, even though it's zoned for this, there's a moratorium right now. So if you're doing an event um type of business, you can't do that at that location at this time in city stop right there. Right. As a matter of fact, what we decide to do based on the last [2:04:33, 2:04:53]: Is that anyone that comes in because we had a tattoo guy on Friday? We've had a couple other folks that have come and we've immediately told them that there was a moratorium and they immediately asked for an appeal. And I will say that I've talked to the city attorney. I think we uh got caught off guard because I'm not typically used to a appeal process in a moratorium. [2:04:53, 2:05:13]: Some jurisdictions do them, some jurisdictions don't. And I think me and the city attorney are just gonna talk about what jurisdiction because all of the years that I've done moratoriums, we've never had an appeal because it kind of defeats it. But the attorney said there is case law out there to support the appeal. Um what we're supposing, what we're hoping to do is [2:05:13, 2:05:29]: is because there are a number of like the tattoo guy, I'm gonna have to put him on the next agenda, uh, but we just kinda need to get a a handle on these as quick as possible so that, you know, you guys are not hearing these, you know, every every council meeting. Correct. [2:05:29, 2:05:49]: And and again I I think that I I would suggest that the council do its best to delineate what those assembly uses are, because that's gonna come up again if somebody wants to to build to to have some type of business that could be uh assumed to be assembly. Okay, those are established by federal guidelines. We don't do that. Um so we don't have [2:05:49, 2:06:09]: Have any decision in what makes up assemblies, those are s established by the federal building codes. And they give a list and say these type of uses are assembly and we can't veer from that. I understand that. But what I'm saying is that since we have a list, I think that the list should be here with A, B, C, or one, two, three, so that we know what it is. [2:06:09, 2:06:17]: Instead, we know what a nail shop is and tire shop is, but we don't know what assembly uses are. So we should have that as a list of things so that we won't have to go through some. [2:06:17, 2:06:37]: So what we'll do, we'll add the code section because it's a it's a bunch of them. And so then somebody can go through and they can see the 50 or 60 that are listed because it's movie theaters, uh it's churches, it's event centers. I mean, anything that deals with really more than 15 people getting together to do something other than retail falls under that assembly. [2:06:37, 2:06:47]: So it's it's a broad list, but we can't address this. Is that a reasonable request? Seems like that seems like a reasonable request that you can do that and get that back to us. We do, we can do the site. [2:06:50, 2:06:52]: [7614.8, 7615.5]: Okay. [2:06:56, 2:06:58]: [7620.0, 7622.4]: religious institutions move the early [2:07:03, 2:07:11]: So it's already really identified. It's just an it's just not specific beside the resolution to you know that definition, but but it's it's [2:07:15, 2:07:35]: But I did want to add one thing because I kind of see the councilmember where he may be headed. If you do grant the exemption, it's important that you state for the record the basis and the criteria upon which the exemption is run. And if I understand Councilmember Alexander correctly, what he's saying is. [2:07:34, 2:07:54]: That any future regulation as it relates to Cindy uses or some of these others won't necessarily apply to standalone buildings on your own on one piece of property. And if that's the case, then that's the basis for granting an exemption in this case, but you might not have that circumstance. [2:07:59, 2:08:04]: So on that note, does it does the motion need to be restated or or are we clear with the motion the way it stands right now? [2:08:05, 2:08:05]: You can't. [2:08:13, 2:08:22]: Yes, that's the reason. Amended the motion to the language stated by the city attorney. Okay, one one second. Does that mean if he if it amends it doesn't doesn't need another second? [2:08:23, 2:08:23]: Wow. [2:08:24, 2:08:24]: It'd be helpful. [2:08:25, 2:08:45]: I second. Okay, there we go. On that note. Okay. We've got that covered. Yes, ma'am. Go right at the end. Thank you. Um, thank you. Um, Miss Moore, you mentioned that there are others that appeal, but I think the last time we met, council only wanted to hear appeals from the assemblage portion because of the [2:08:45, 2:09:05]: the wide range of variety there. I don't think if it was a tattoo parlor or something uh to that degree a store that we wanted to hear an appeal process, it was more so for the for the for the term of what the assemblage was for. Okay. The purpose of that [2:09:05, 2:09:25]: that and so do we do that by using the word standalone or how do we go about that? But you speaks to everybody denied um the opportunity to submit an application to appeal back to the goes on to say that um exemptions will be grant [2:09:25, 2:09:45]: if the anticipated regulation if the particular project is consistent with what the anticipated regulation would be. And so what we're heard tonight is we anticipate regulating these standalone facilities like we would regulate the shopping system. [2:09:45, 2:10:05]: Correct. So you've met that requirement. If you you know if you wish to amend your moratorium to not allow for appeals at all, then that that would be better than to amend it to allow appeals for this type of use, but not for these types of pieces. [2:10:05, 2:10:25]: What it will do is that it almost puts you into a zoning case. Because we we I'm I mean, I've got a list right now where people that actually, when we told them no, they said, I'm I want to appeal it. It's gotta be somebody I can appeal it to, the vapor shop, the tattoo place. Um and so, you know, my thing was that, you know, typically I, you know, the more [2:10:25, 2:10:39]: moratorium is supposed to kinda close it until you fix it with no appeals because we have it there. You know, if somebody says, I wanna appeal it like the tattoo guy did on you know Friday, you know, we have to send him an application, so [2:10:40, 2:10:50]: And I think again, I think the resolution does state in here that that you have certain vested rights when you're when someone in uh zoning or or or in that area [2:10:50, 2:11:10]: Gives you assurances that that you won't have to deal with any of this, or or that you meet all the criteria to start your business and to get zoned properly. So I think that that's what we're falling under, where we have had certain Miss Kennedy's had certain assurances that everything will be okay moving forward and that she's asked someone in the [2:11:10, 2:11:30]: in the zoning and and um planning um department and they gave her assurances that she could start and begin a business we're okay with that we're okay with it we're not we're not talking about we're trying to fix what we're trying to do is fix after tonight all right what I'm saying make it clear what I'm saying is that what I'm saying is that [2:11:30, 2:11:50]: In the future, this pr people will have to fall under the same criteria basically if they wanted to have an appeal in accordance to this. Right, but the point is you have to have a criteria for well why did you deny the tattoo shop? Why did you deny the vapor shop? I think at this point I'm putting [2:11:50, 2:12:01]: Please come up here, please. Could you swing around and come back? Sure, sure. I think at this point, um Mr. Mayor, um take a vote. Attorney. [2:12:02, 2:12:22]: City councillors. I think at this point we all have seen what happened here. And Miss Kennedy, I've known her for over 20 years. Outstanding citizen, um, involved in a lot of community, the Jamaica Association and all of that. And I think she would do very well in Stockbridge Waller Steel. [2:12:21, 2:12:41]: Stealing away her away from us up so so we got it. We got it. We got we got it. So I'm asking please, as her broker, I did my job in saying do your due diligence. So any other any other comments down here? Yeah, I want to put it in the record. Thank you very much. [2:12:41, 2:12:50]: much have a great moment. Really I want to put in the record my the reason I'm approving it is because she became vested after the fact. [2:12:51, 2:12:54]: She wasn't told about memoriatorium. [2:12:54, 2:13:05]: And so she became invested after invested invested financially after the fact. That's my decision of approving her. And so I just want that to be in the record. That's why I'm approved. [2:13:06, 2:13:07]: Thomas, do you have anything to say? [2:13:09, 2:13:29]: Mrs. Kidd, it's good to see you again. Thanks, Mr. Thomas. And I know originally you reached out to me and I I had some things to say, but I I think it's clarified, but I think it's very obvious that, you know, council and staff, we need to go back and and the conversation sort of talked about the fix. And and I think we're going [2:13:29, 2:13:31]: Yeah. [2:13:32, 2:13:42]: You did call me, um I I didn't really know you. Um we just met at the Caribbean Hamburg Day. Right. That was the first time we met. This is the second time I actually seen your face. Um [2:13:42, 2:13:45]: But we are pro business. [2:13:45, 2:14:05]: And and you know, there's a lot of things that we do need to fix going forward. I'm just glad that we do have a uh a motion on the table. We had a second, and it seems that everyone is going to approve this. But I I just my recommendation to the staff is that, you know, we may need to look at the whole moratorium and as your your turn. [2:14:05, 2:14:07]: Um [2:14:07, 2:14:10]: Other items in this sort of clear. [2:14:11, 2:14:12]: But the assembly and [2:14:13, 2:14:15]: I don't think beforehand [2:14:15, 2:14:18]: Uh, we as a council, and I pride myself on. [2:14:18, 2:14:19]: Learning. [2:14:19, 2:14:22]: and you know and and gathering information. [2:14:22, 2:14:24]: But you know, we was told [2:14:24, 2:14:25]: The whole state [2:14:26, 2:14:29]: And the federal regulations for assembly. [2:14:29, 2:14:33]: And at that point, then we did, and I think even staff. [2:14:33, 2:14:42]: downstairs, Mrs. Moore. I think we all now need to you know, to know that we need to get some education. But I just wanna say I'm just glad that you came [2:14:43, 2:14:51]: This whole process was that the fact that we were able to learn and be educated on this because every day. [2:14:51, 2:14:53]: We're trying to make this city better. [2:14:53, 2:15:13]: Even though there may be bumps in the road, but at the end of that last bump, then we are better for that. And I think you bringing this issue before us, we are better now as a city to make sure that these kind of things that, you know, we need to straighten out. So congratulations. Welcome to the city of Stockbridge. Thank you, Mr. [2:15:13, 2:15:33]: Let's vote, please. I'm ready to vote. Yeah, based on uh uh uh the uh the recommendation, let's go ahead and uh make this motion and amend this motion to the language described by the attorney, but removing all appeal. [2:15:33, 2:15:41]: appeals uh out of the process from this point forward and exempting standalone buildings. [2:15:42, 2:15:45]: Wait. [2:15:47, 2:15:47]: Yeah. [2:15:52, 2:15:52]: Okay. [2:15:54, 2:16:14]: Just vote on okay. Let's go ahead and move mo move forward with this one. We'll go ahead on this one. Let's go ahead and move on this one on the late motion now. Yes. Okay, second. All favorite motion, please indicate. Okay. Okay, see now. So okay, so you granted granted your waiver. Now thank you so much, Mr. Mayor. Thank you, thank you. Thank you. I you know I'm [2:16:14, 2:16:34]: I'll do it. I make a motion to remove all of the um appeals uh in regard to this one and then to in regard to the moratorium and to insert the language that standalone buildings uh are exempt from this particular moratory. [2:16:34, 2:16:51]: Standalone assemblage. Standalone assemblage is amended from this particular moratory. I just have one f what do you just still want to hear those that have asked for appeal, which I think is like oh well. Well I I don't even have one opinion. It's not part though later. [2:16:51, 2:16:53]: Okay.'Cause I I mean they've [2:16:55, 2:17:08]: Second. Okay. Yeah, it would need to be discussed. It would be discussed later. You got a motion on the floor. You you just asked for seven. Second. Okay. All right. Do d does the clerk understand got everything on okay. Any further discussion on that motion? Mr. Mirror. Yes, sir. Um [2:17:09, 2:17:10]: Uh [2:17:11, 2:17:20]: I guess the problem that I have and just going back to the applicants that are already in the harper and they have been [2:17:20, 2:17:27]: Told or informed that they can't appeal. Well that I think we'll stay five it's five. So so [2:17:28, 2:17:30]: So my my my my issue is [2:17:31, 2:17:36]: If that's what they have been told, I know we have a motion to wipe that out altogether. [2:17:36, 2:17:38]: But if they have been told that they can appear [2:17:38, 2:17:44]: And now we're saying that they can't appeal. I just wanna just put that on the table. [2:17:48, 2:18:08]: Yeah. But it's coming out of the fact that would start beginning today. Right. So anyone who is, you know, they don't have a vested right as it relates to the use, but they probably have a vested right as it relates to the appeal. Right. So there was just fine. Um but now that the the understand what the criteria [2:18:08, 2:18:15]: You know, was anticipated based on what you just did, we can communicate that to these folks and they can make a decision. [2:18:17, 2:18:36]: So that satisfy your requirement. Well, let me let me be clear. So the five that's in the harper, they have been told that they can't appear. Now we're gonna go back and say, Well now you can't appear. No, no, no, no, no, no, no. That's not what he said. Okay, that's really no matter for clarification. So those five that's in the harper, can they still appear? Yes. [2:18:39, 2:18:41]: Once they get here. [2:18:42, 2:18:47]: before they hit you to explain to what what your decision making process was. [2:18:51, 2:18:56]: See what what where I'm going with this, I just wanna be clear because I don't want it to be a case like Mrs. Kennedy. [2:18:57, 2:19:03]: You know, being taught one thing and then it's another thing. I agree. So I just want to be sure on that. Okay. [2:19:03, 2:19:07]: We're clear. Any further discussion? All in favor of motion, please indicate. [2:19:08, 2:19:12]: Okay, Jeanette. All right, good deal. Thank you, ladies and gentlemen. Appreciate it. All right. [2:19:14, 2:19:16]: Okay, good deal. [2:19:16, 2:19:29]: All right, uh Council Consideration approved j you two. Council consideration approved JOHCO development standards and site plan. Miss Moore, please. That's that's all for you. Wasn't it did your motion you take that off? [2:19:30, 2:19:36]: No, they said inject no gesture. Oh, okay. [2:19:37, 2:19:57]: Oh, okay. Oh, I'm sorry. Um, on the design guidelines, um, we submitted a draft proposal guidelines to um the owners of Jodico and where we are right now is that they wanted to take some time to look at those, peruse those, pull all the parties together that may have be interested in certain [2:19:57, 2:20:09]: segments of developments of the site. And we're scheduled to meet tomorrow at two thirty so that we could work through all of the details. And Jeff is here. Just wanna come on up and give your [2:20:10, 2:20:11]: Comments. [2:20:11, 2:20:31]: And and I will say that after we meet tomorrow, it's probably gonna iteration is probably gonna go back and forth until we finally get to uh where we think the item is good. And what we would like to ask is that uh until we until they're ready, that it does not show back on the agenda again. Okay. Until we're actually ready for it. [2:20:31, 2:20:32]: For it to go. [2:20:32, 2:20:37]: Miss Grant, ms thank you for being here, sir. How w how you wanna address what what do you wanna say, sir? [2:20:37, 2:20:57]: Well, I just wanna tell you guys I I feel sorry if you guys not uh you know. But no listen, uh I wanna tell you guys this much. We we we really appreciate uh you guys are uh appreciate more than you realize. And and certainly with us I I can tell you this that uh y'all been great to work with. The the hold up and and I [2:20:57, 2:21:17]: I apologize. It's probably more on our end. We have taken the development agreement and given it to all the vendors. Thereby we've been talking to to get their their uh comments back as well. We've we've integrated those in. I think you're gonna find out that there's not really a whole lot of major changes made. Most of them are minors. There were a few things that we we did change that we're we're gonna discuss with uh [2:21:17, 2:21:37]: uh Camilla tomorrow. And so uh hopefully we'll have this thing ready. I think this is really the last piece of the puzzle. And I tell you guys, this is something we're to the point now. We've we've taken this long, it's taken all the time and and and effort we've all put into this. You know just in case something ever happens, the [2:21:37, 2:21:57]: any of us in this room. We want something that can live on that we all can live with, that we're all gonna be proud of. And so we're making an effort on our end as well uh to make sure this that to ensure this this is going to be a great project. And I think you guys will be very happy with it as well. We'll be discussing here shortly with you. We we have also hired a um [2:21:57, 2:22:15]: A marketing group that uh we'll be meeting with y'all here very shortly once this last piece of the puzzle is done with the development agreement, uh that I think they want to work in conjunction with the city. Uh I think you're gonna be very proud of what we got to offer here very shortly. And we're excited with some of the vendors we have coming in and some of the restaurants. So we're [2:22:15, 2:22:35]: Uh we've put a lot of effort into it, a lot of time and and w we're to this point so there's no need trying to push this. So I I I agree that I think once and and I really think this will be done here in the next uh maybe this time next week, two weeks at probably at the most, but we should have this done. I think we've got all the comments back we need from our vendors and I think we're ready to [2:22:35, 2:22:55]: proceed. And she's been very patient with us, so I appreciate y'all's patience as well. So you've been meeting with the staff tomorrow to work out all these details. Yes sir. Do I dare ask uh does anybody have any specific questions? You know you know he's gonna meet with staff tomorrow. Do I dare ask that? I mean I think uh he's he's outlined it pretty decently. Are we good with this explanation of this point? [2:22:55, 2:23:06]: All right. I think we're good, sir. Let you talk with the staff. Thank you for being here. Really appreciate your patients. You too now. Take care. See you tomorrow. Thank you. Thanks for watching. [2:23:07, 2:23:10]: All right, uh council consideration to approve. [2:23:10, 2:23:14]: Policy for theft of service and tapering of water meters. [2:23:14, 2:23:16]: Mr. Aaron, please. [2:23:20, 2:23:40]: Uh yes, Mr. Mayor. Uh coming forward, Mayor and Council tonight to ask you to adopt this policy. We've had some instances where builders are going in and uh connecting to the water service without paying for services. And also some instances where utility services have been turned off for non-payment and people have gone in and turned them back. [2:23:40, 2:23:54]: on themselves. So we just wanna address this issue and have a policy in place because if you do it outside of the water department, there's a potential that we could get contamination into our water system. So we just wanna have something in place. If somebody [2:23:55, 2:24:00]: does turn on a service that they're not authorized to do it, that we have a a policy that we follow. [2:24:00, 2:24:13]: Okay. And that's the policy that's in the book right here for us. Okay. Yes I'm any questions for Mr Aaron, ladies and gentlemen. Anybody? Ma'am. Ma'am. Yes, ma'am. I move that we approve the policy for that reserve tampering with one meter second. [2:24:14, 2:24:25]: All right, so for discussion? All in favor, please indicate. All right, thank you, sir. Thank you. Thank you, Council. Council consideration to approve Council consideration to approve policy for um [2:24:25, 2:24:44]: Water leak adjustments and application process. Mr. Aaron, please. Yes, Mr. Mayor. Uh the city also already has a policy and we just want to formalize this policy so that everybody knows this is the official policy that the city has adopted. This is what the city is currently using to adjust water bills. We just want to formalize it. [2:24:45, 2:25:05]: Okay. All right. Any questions for uh Mr. Eric? Yeah, one question if I could. So have we uh since we won went to the automated meters, have we seen any what are we seeing in terms of of per week or whatever uh folks having this issue uh after we've gone to the automated [2:25:04, 2:25:24]: Automat. Have we seen any uptick in that, or is there a certain number that you can give us on any meter errors? No, sir. Uh we haven't noticed an increase in anything like that. But one of the things we are we're gonna probably come back to you in about a month, where's an additional piece to it, which is called a customer portal, and we're talking to the [2:25:24, 2:25:39]: uh the vendor about that where people will be able to go online themselves and monitor their own accounts. If they're away from their home on vacation or whatever, they can monitor their account remotely so they'll have access to to the meter information. [2:25:40, 2:26:00]: Follow one follow-up. Now there was some talk when we originally approved these meters that said there would be automatic notification when somebody had a surge in water usage based on this. Is that going to be implemented or has it been implemented? Yes, sir. They do. They receive a call that there's some abnormal usage. And one of the things is the criteria. [2:26:00, 2:26:13]: criteria is if it goes on past like ten hours, then you that person receives a call that there's a constant water use, they'll receive a call from the utility building department over the possibility of a leak. [2:26:14, 2:26:19]: Yes, go r go right, please. Mr. I I'm a little familiar with this item. [2:26:19, 2:26:24]: It seems that during the winter months when pipes are bursting and [2:26:25, 2:26:27]: You know, there's water running, especially on the ground. [2:26:28, 2:26:30]: Does it come into effect whether [2:26:31, 2:26:46]: The leak is on the homeowner side or on the city side? Well, if it's on the city side it was it would not register through the customer's meter. This is for water uh usage that registers on the customer side. [2:26:46, 2:26:49]: And so this would allow for if there's a [2:26:50, 2:27:10]: Obviously if there's a pipe that burst and I did read this where uh I think in the past it required that homeowner to hire a plumber to come in and to do the work and then that homeowner had to show that receipt. You have one or two choices. You can have a plumber being done. You can have a plumber repair it or you can repair it yourself, but if you repair it yourself, you gotta bring receipts. [2:27:10, 2:27:13]: for the the items that you purchased to make the repair. [2:27:14, 2:27:15]: Who write it? [2:27:15, 2:27:32]: Real quick, it's kinda in line with what Councilman uh Alexander was saying is uh because when I looked at the policy it it stated that if there is an excessive usage uh you know, abnormal usage, that you all would take the last three bills. [2:27:32, 2:27:52]: To calculate, but how would you let it go that far if we uh communicating with the Well see now? Here's the reason why you do three months because you read from the middle of the month to the middle of the next month. So it could be if your bill, you got your March bill, it could be part of March and part of April, because that bill is read in the middle of April. So you want to [2:27:52, 2:28:12]: ensure that it's favorable for the customer that they get the best adjustment possible because if you just do it for one month and then you have bleed over from the previous month then it's still gonna have a w high water bill in April, even though the leak occurred in March. Yeah just follow up no I got that but what what what policy do we have in place [2:28:12, 2:28:32]: When we see that it's been it's done for say a month and a half, is that this leap? What do we have in place to contact those? The customer receives a notice from the city that there's a possibility that they have a leak because their account has shown prolonged usage. And so that person receives that notification. [2:28:33, 2:28:43]: And so it's it's on that homeowner, that customer to to go and check and see if they've got a leak in their home. We're just telling it that they've got abnormal water usage. [2:28:46, 2:28:57]: Okay, any other questions? No other questions all in favor of the um oh no well I'm sorry, excuse me, has the motion been made? I don't think so. Okay. Mayor motion please. Mayor I'd like to appro approve um [2:28:58, 2:29:02]: I move that we approve the policy for water leak adjustments and application process. Okay. [2:29:02, 2:29:05]: After the second's all the way down to the end. Any further discussion? [2:29:06, 2:29:10]: All favor please indicate. Okay, I'll stand. Okay. Thank you, Mr. Aaron. [2:29:11, 2:29:18]: Uh council consideration to fill vacancies and appoint a members of the youth council advisory committee. Miss Harvey, please. [2:29:27, 2:29:29]: Good evening, Mayor and Council. Good evening. [2:29:29, 2:29:47]: Um, first I would like to thank you guys for opening up the application process to the Henry County residents. That has definitely opened up the opportunities for some amazing candidates for the uh Youth Council Advisory Board. So at this point, I just want to go ahead and um get those individuals in place so that we can move forward and get to work. [2:29:48, 2:29:51]: Okay. And we're looking for three vac three vacant positions? [2:29:51, 2:30:11]: Yes, we have three vacant positions. Okay. However, there are some amazing candidates, five of which I'm aware of, not that I know personally, but I've done my research. And the other four, I'm I don't know who they are, so they could be uh really gr uh well to I wanna find a way to be able to utilize whoever really wants to work with the youth. And so, like I said, we have three [2:30:11, 2:30:13]: Amazing candidates. [2:30:13, 2:30:23]: But just kinda figuring out how to move forward. So you like to see it expanded. So the question would be, can we even do that with with the regulatory guidance here with the youth council, can we even do that? [2:30:27, 2:30:30]: So do we have to change anything in reference to the bylaws, anything along those lines? [2:30:31, 2:30:32]: Yeah, right. [2:30:35, 2:30:55]: Okay. Uh and typically counsel when we do this, we typically take these uh individuals that apply for this particular appointment, we normally talk about the executive session and come back out and make that announcement. That's what we typically done in the past. I'm assuming that's where we want to take it tonight as well. So yes. Okay. [2:30:55, 2:31:15]: I think uh sometimes it's helpful that we've had Kira and the representative make recommendations as well. Okay. Because we're just looking at applications and she's got to work with these people uh every day. So So otherwise on that note, I've taken to the fact we're going to second session. You would join us in the second session for this piece, give your recommendation, and then we'll decide. [2:31:14, 2:31:34]: then we'll come back out of the second session and give you the uh give everyone the decision on that aspect. Yes. Okay? Okay. Okay. Thank you. So we'll we'll do that. We'll go into second session and at least talk about this issue. So okay thank you. Thank you. On that note then we're to our comments. Uh madam clerk if you re reset the clock please. And [2:31:35, 2:31:37]: Mr. Uh Knighton, sir. [2:31:37, 2:31:50]: Just that the uh course of summer concert uh will be held this Saturday. I look forward to uh great summer concert and uh hope that everybody will come out and join us on Saturday for a great summer. [2:31:50, 2:31:51]: Thank you. [2:31:53, 2:31:57]: We no comments for you m uh clerk? All right, uh Mr. Thomas, sir. [2:31:57, 2:32:13]: Uh just briefly just wanna speak to the residents from uh Pine Grove that came out. Just want them to know that we heard them tonight and we will uh get results on this. All right. Thank you. Please set the clock for Miss Holiday. [2:32:16, 2:32:18]: Thank you, Mr. N uh Mr. Blount. [2:32:20, 2:32:40]: Yeah, I just wanna um also echo those uh sentiments. Um I just believe that we all because one of the things that we talked about even in the time of trying to save our cities that we all are better together. And I think we all are better together and that's working together and that's being a one sound mind and everybody saying the same thing. [2:32:39, 2:32:59]: And then when we get to a point where we're not saying the same thing, how do we get back online? How do we get back to a place where we're all on one accord and shooting toward one goal? The city hall and this chamber should never be used as a battlefield, but as a pro as a place for progress and a place to make a difference. [2:32:59, 2:33:19]: start using it as a battlefield and nobody wins because war is never good. So let's use the let's use this time and chamber to always try to move things forward and get things done. Because this city's about results. Your lives should be about results. And so when we start to get on one accord then we'll see results. We all want [2:33:19, 2:33:35]: minded when it comes to wanting to see progress in the city. That's in our communities. That's in economic development. That's in everything that we're doing. So I think uh the the citizens that came out tonight, I'm elated to see so many. That was all that was awesome. And I just ask them to keep up the good work. [2:33:37, 2:33:38]: Ms. Gantt, please. [2:33:38, 2:33:58]: Yes. Um thank you to all the citizens who've hung around and thank you to those citizens who did come out tonight um and express their their views and their concerns about their community. Um we always say that we're six and there are tons of views, so we wanna hear those those opinions and and do what we can. Um [2:33:58, 2:34:18]: um as best and as legal possible as we can do. Um so I thank you for that. Tomorrow is um Food Truck Tasty Tuesdays. And we're doing something a little bit unique tomorrow. Um Food Truck Tasty Tuesdays, this is our fourth year. We're really excited. We've been doing some great things. It's a great time to come [2:34:18, 2:34:38]: out and enjoy the community. And tomorrow we're having a pop-up farmers market. They're coming from Atlanta area with fresh produce. A lot of them had pre-ordered, but there are limit there are some produce that will be available to purchase tomorrow. So we ask that you come out and support that. [2:34:38, 2:34:58]: The more people we can get to show interest and support, they may help us to form our own community garden right here in Papa and Food Market here in Stockbridge. So um just want to thank you guys again for all the support and the concerns and you know, all of our answers aren't the answers you want to hear, but [2:34:58, 2:35:09]: I don't want to sell anybody a dream. Um, I want to be honest and and do what I can for the best interest of Stockbridge and for your communities. Thank you. [2:35:09, 2:35:29]: Mr. Anderson, please. Uh I'd like to thank everybody for tuning in and appreciate the large crowd that came out today. Uh, just want everybody to understand we need that type of participation uh at every meeting because it's good when people partake in the democratic process uh to be heard and involved because when you're at the table uh [2:35:29, 2:35:40]: From day one you understand that uh decisions that are made up here affect your lives. I hear everybody talking about what's going on in Washington on a regular basis. [2:35:41, 2:36:01]: And watching CNN and Fox, but they really need to be watching local access TV to understand these decisions affect your home, your property values, and everything related to your life on a daily basis. So stay engaged, stay in tune. Uh I'd like to um want to say one other thing as well. [2:36:01, 2:36:07]: Over uh in my community, uh we have a road project called Campground Road Extension. [2:36:07, 2:36:11]: Uh for some reason the Henry County decided not to bill [2:36:11, 2:36:22]: that particular project with sidewalks uh for a major expanse of it. I think the conversation is centered around uh my particular community, which is Winslow at Eagles Landing. [2:36:22, 2:36:30]: But I want everybody to note this is not just about Winslow at Eagles Landing, this is about almost a half of that road project. [2:36:30, 2:36:50]: That is being built with no sidewalks, no lighting, and uh no bike lanes or anything like that well on a on a road that has a forty five mile per hour speed limit. That's unconscionable. We should be moving forward, uh building better roads, building better facilities, uh embracing [2:36:50, 2:36:51]: [9411.3, 9416.2]: uh connectivity and safety, uh not building projects like this. [2:36:56, 2:37:16]: Let me state this categorically today, and the city manager can correct me if there's an error in my statement, which is this was a 100% Henry County project. The city never had any involvement in it. Uh, we that right-of-way was donated to Henry County by the [2:37:16, 2:37:36]: Developer, even before it game came into the city limits. The county owned that right away 100%. And when the subdivision was annexed, or all of Campground Road was annexed into was annexed in the Stockbridge, a lot of the surrounding uh communities like the Terrace at Angels Landing, the Magnolis at [2:37:36, 2:37:53]: Eagles Landing, those subdivisions were annexed into the city, but that right-of-way was never annexed into the city. So at this problem, that's been a spLOS project that's been the on the budget uh on Henry County SPLOSS for extended a period of time. [2:37:53, 2:38:13]: That particular splost account had extra money in the account. That money was transferred out of that spLost account to cover other projects when that probe project is being built in a inferior capacity. You need to reach out and demand that every road project be honored the city ordinance to build with sidewalks. [2:38:15, 2:38:16]: Ms. Robinson, please. [2:38:16, 2:38:36]: Thank you, Mayor. I wanna thank everyone for coming out. I also wanna congratulate the fourteen youth that um teen ambassadors that we did a pinning ceremony today. They're gonna actually do some dynamic things. We got a lot on the um calendar that they're gonna represent our city well. Um so be on the lookout for them. Um [2:38:36, 2:38:56]: They're amazing. I mean, their interview process, there are some amazing young people that really, really are ready to shine in our community. I just want to say to my Pine Grove community, thank you so much. We have a voice, it was heard tonight. [2:38:56, 2:39:16]: And we've been in this fight a long time and it's not over. Um, because what we're going to do, as it was stated by staff, we're gonna make sure that we put some people together um and make sure that they come up to City Hall and get answers so that way we can communicate. So I just wanna publicly say that that we're still [2:39:16, 2:39:19]: gonna be pushing forward to get what we need. [2:39:19, 2:39:21]: Um to be able to be a [2:39:21, 2:39:23]: Ком'юніті аза хол агін. [2:39:23, 2:39:43]: So again, thank to thank you to my community. Thank you to my colleagues for hearing my community. And I just pray that everything that you stated up here in your ending comments, that you're going to stand boldly on that and to ensure that these residents, all of us, are made sure that we get what we deserve for our community. [2:39:43, 2:39:45]: Thank you so much. [2:39:46, 2:39:46]: Okay. [2:39:48, 2:40:08]: And I appreciate the fact that uh that we had a lot of uh say uh citizens or residents interaction today. Uh and this is what it's all about. And we represent you and you've elected us to office and uh so we it's always good to have that dialogue and try to get to get down to the nitty-gritty and get it straight so we know what direction we're going in. [2:40:08, 2:40:28]: in this aspect. So I encourage the constant dialogue at all times and communication on what we're doing and how we're doing things. And to make sure that we satisfy the requirement for at least the majority of the people in a sense that it that we're satisfying, you know, what they need and what you need and what you want and uh and how we go forward. So keep the faith as we continue to make [2:40:28, 2:40:34]: Make things happen and work through the issues and concerns that you may have as citizens and open dialogue is always the key. [2:40:34, 2:40:38]: I wanna congratulate uh Michael Harris. Michael Harris is a [2:40:39, 2:40:43]: a Startbridge not only Stoppridge residence, but also a senior at Stockbridge High School. [2:40:43, 2:41:00]: And Mr. Harris uh was picked up on the third round for the Atlanta Braves and and as a pitcher, I think it's primarily a pitcher but also an outfielder. But uh congratulations to him. And I have to admit, uh being a young guy that grew up in Saint Louis, Missouri, and the St. Louis Cardinals are the team there. [2:41:00, 2:41:18]: And I grew up uh playing baseball myself and being a pitcher as well, but obviously I didn't get a contract to go to the pros, but uh that's all right. You know, but I'm happy for this young man and and uh and I thank him for doing such a great job and I hope he does well in in the pros is uh in this aspect. So I can look at him on TV and say, I know that guy, right? [2:41:18, 2:41:38]: Hey, listen, be with us always and uh God bless you all and keep the faith. All right. Uh let me read some announcements here. Uh City Kelsey, U Council Advisory Committee meeting, Wednesday, June 19th, 6:30 p.m., Levi Room. It was mentioned Sound of Summers this Saturday, June fifteenth, from uh roughly says eight eight eight. Well, actually it starts about six thirty. But uh what's key about this concert is that uh you're supposed to wear your best white outfit. We're gonna have a little contest on the best white outfit. So wear white everybody. [2:43:35, 2:43:55]: Monday, but it's actually going to be this month on June 26th, Wednesday, June 26th at 10 a.m. Let's see here. Okay. I believe that that's got all those announcements. On that note, I will say to you that we do we have at least one item for a second session to deal with the the uh Stobbers Youth Council. I'm pretty sure we have several different [2:43:55, 2:43:58]: Okay so counts. [2:44:00, 2:44:06]: There we go. I need a motion, folks. So moved. Is the second? Is there a second? [2:44:07, 2:44:09]: Is he second? Who's second? Yes, second. [2:44:09, 2:44:19]: You second that, sir? Okay, good. Mayor Pro uh mean Mayor Pro Tem Blount second that. All in favor, please indicate. All right. All opposed? All right, we'll go to second. We're back, folks. [2:45:14, 2:45:16]: Um pot. [2:45:17, 2:45:18]: [9919.8, 9920.5]: [2:45:30, 2:45:30]: Yeah. [2:45:32, 2:45:33]: There's a lot of information. [2:45:34, 2:45:36]: Right. [2:45:51, 2:45:52]: Yeah, yeah. [2:45:54, 2:46:05]: I hope we put the time at least we might have too much to get into the [2:46:06, 2:46:08]: Well I will call you at eleven AM sharp. [2:46:17, 2:46:20]: Yes. By the strike. [2:46:30, 2:46:39]: I just read your own night. I didn't see this. [2:49:05, 2:49:07]: Is there a thing? [2:49:08, 2:49:09]: Yeah, that report. [2:49:09, 2:49:10]: [10151.0, 10155.0]: [2:50:06, 2:50:07]: W it was in the book. [2:50:16, 2:50:18]: Okay, that's it. [2:50:49, 2:50:52]: I guess so. Can we get a tower for a second? [2:50:52, 2:50:55]: Yeah, so you guys should have. [2:50:58, 2:50:59]: Well, it's a [2:51:50, 2:51:51]: No hard. [2:51:51, 2:51:53]: Yeah, so seven and six. [2:52:20, 2:52:20]: Okay. [2:53:00, 2:53:10]: We have only uh this uh declarative Dublin. It's like and I will say three. [2:53:25, 2:53:35]: We don't think that they have those concepts, but we don't [2:53:56, 2:53:57]: You comment. [2:54:05, 2:54:14]: But someone is fingers. So how does that work? And and then we tell you something that's more ways to use the each way. [2:54:14, 2:54:21]: Um and uh the management of being entirely is the determinant that's going through. [2:54:27, 2:54:28]: Radiation. [2:54:29, 2:54:30]: Yeah. [2:54:39, 2:54:40]: Yeah. [2:54:42, 2:54:43]: I think it's [2:54:47, 2:54:48]: Yeah. [2:54:51, 2:54:52]: Okay. [2:54:58, 2:55:07]: Which I'm going to understand if you're in the same and the state report because most H are under that requirements in the heater you can do. [2:55:07, 2:55:11]: It was interesting. [2:55:12, 2:55:13]: Oh my god. [2:55:13, 2:55:19]: It shouldn't be ten dollars. But people charging a hundred, two hundred, three hundred dollars or stuff. [2:55:19, 2:55:21]: But really is a mic so [2:55:22, 2:55:23]: Yeah, to do it. [2:55:24, 2:55:27]: Oh I want to go to a turkey on the sea. [2:55:27, 2:55:36]: I wanna tr maybe try and put on contact. I mean, I don't know as it don't as much as I can. But but y'all have to gather a lot and gather. [2:55:39, 2:55:40]: Yeah. [2:55:48, 2:55:52]: Yeah, exactly what they can have. [2:55:52, 2:55:59]: to have a second time if that makes sense. Well the the thing here that I'm most despairing [2:56:00, 2:56:12]: I don't want to be covered by seven rooms down to I would but and then you can look at them you don't know what's going on. What they're telling you today is uh control the build for two [2:56:15, 2:56:18]: Let's use the only challenge up and hex channel.
