[0:18:46, 0:18:51]: My name is Corinne Randazzo. Address is one eleven Bryant Street, Stogbridge, Georgia. [0:18:52, 0:18:56]: Um come before you today to ask you to respect existing laws like [0:18:56, 0:18:59]: No through street, the noise laws. [0:19:00, 0:19:08]: We are not even close to constructing the amphitheater and we've already had a hundred empty dumpster trucks go over that speed bump and back. [0:19:08, 0:19:10]: It shakes the house. [0:19:10, 0:19:13]: When they cut off the traffic at eleven o'clock at night. [0:19:14, 0:19:15]: They woke us up at five in the morning. [0:19:16, 0:19:18]: So if y'all can contain the construction. [0:19:18, 0:19:20]: Between Lee and forty two. [0:19:20, 0:19:21]: That'd be great. [0:19:22, 0:19:23]: Um please consider [0:19:24, 0:19:29]: Changing the humps to bumps or the bumps to humps, the long humps. [0:19:29, 0:19:33]: Like between Davis and Valley Hill,'cause it kills some of the noise. [0:19:34, 0:19:35]: What else? [0:19:36, 0:19:40]: Uh open records on the amphitheater. I've been trying to get [0:19:41, 0:19:48]: A picture of the setup of the emitters, how many emitters, how much money, the noise cancelling scheme, and I haven't been able to get any of it in [0:19:49, 0:19:57]: Forty-five months, met with the mayor, I tried today, I tried with TSW today, and I was told the open records were closed. [0:19:58, 0:20:00]: And nothing was ever delivered on it. [0:20:00, 0:20:05]: I haven't put the third or fourth one out and lost count now. Hadn't put it in yet. [0:20:05, 0:20:08]: But I'd very much like to see the documents so I can make some decisions. [0:20:09, 0:20:10]: Or what to do with my life. [0:20:10, 0:20:16]: my property.'Cause I am right on it. You walk out of my back door and it's five hundred feet. [0:20:17, 0:20:17]: Thank you very much. [0:20:18, 0:20:25]: Thank you, sir. Uh well what will happen is that we've got to make sure that uh whatever open records request has come through that we honor that as best as possible. [0:20:26, 0:20:27]: Okay. [0:20:27, 0:20:47]: We did respond to Mr. Randanzo and let him know that what we did not have records for certain things at that time and we responded to that, stating that. And if he wants additional information, you would need to submit a new request. There you go. Thank you. Thank you. Who's next, please? Anyone else? All right. Mr. Rob [0:20:47, 0:20:50]: Robert Kolpack. Robert Kolpack. [0:20:55, 0:20:57]: Name and address, please, sir. [0:20:58, 0:21:03]: Robert Kolpak, two seven two Cotton Indian Creek Road, McDonough, Georgia, three oh two five two. [0:21:03, 0:21:11]: Come before you guys tonight on two items. One is Cochrane Park. I don't know if you guys saw it, but the county's basically gonna keep the park closed. [0:21:12, 0:21:20]: It also removed the scoreboards before anything was kind of finalized and five hundred thousand dollars repair, almost six hundred thousand repair, but we have a [0:21:20, 0:21:24]: Commissioner of District Four that's proposing an eight million dollar new park. [0:21:25, 0:21:28]: I don't know why we need a new park in district four. [0:21:28, 0:21:41]: That's not my concern per se, but my concern would be why can't we put that five hundred ninety thousand to them? So I would ask you guys to go after the county and put the pressure on. Oh, if we I know we were doing an independent study with the city of Stockbridge. [0:21:42, 0:21:51]: So let's see where we're at on that because I don't think the from what I looked at, and I'm not an expert, but I don't think that that the report has actually been done. [0:21:51, 0:21:54]: You can't you can't look at stuff that ain't been dug up. [0:21:55, 0:21:56]: It's not Jurassic Park yet. [0:21:56, 0:22:00]: But but once it digs up, it would be looking like Jurassic Park. It's pretty rough looking. [0:22:01, 0:22:03]: Again, you guys work on this since July. [0:22:04, 0:22:10]: I haven't heard much. I'm just asking the kids are at Hidden Valley if you guys want to go over there with me sometime. It's a joke. [0:22:11, 0:22:22]: Um, they have not done any kind of repairs. Everything I put on C click fix other than a backstop that costs probably twenty bucks, they don't have money. They've shut my basketball courts down and set a level on the ground spending three hundred bucks. [0:22:23, 0:22:25]: That's what we got in a commissioner five. [0:22:25, 0:22:28]: And Commissioner Four, not much better. Um [0:22:29, 0:22:43]: Ninety one days ago on September twenty-fourth, I got an email. Ninety one days my report on a house one oh seven flipping road has not had anything done, been activated. No report back to me saying, Hey, can we fix this? What's even more troublesome [0:22:43, 0:23:03]: Is there's political signs in the yard. I I I don't I don't know who would put a political sign in that property. The um they may have cut the grass, but the house is in disrepair. And that goes with the forced cleanup ordinance we talked about two meetings ago. Let's put a forced cleanup ordinance in. Let's get these properties cleaned up. And we want to make this a better stockbridge. Elton's [0:23:03, 0:23:07]: over there on the on the interstate making it look pretty. I agree with it completely. [0:23:07, 0:23:19]: Well we gotta do something to put some bite in your uh code enforcement people. They are gumming the heck out of everybody, right? They get a they put a warning out, person cleans it up in thirty days, been doing it for three years and and [0:23:20, 0:23:24]: Because I guess she's a commissioner. We protect her. We're buds with her. I'm not friends with anybody. [0:23:25, 0:23:28]: I think what they did at Cochrane's a joke. I think what they've done at Hidden Valley's a joke. [0:23:29, 0:23:32]: I think the one oh seven uh flippin' road property's a joke. [0:23:33, 0:23:33]: I just need some help. [0:23:34, 0:23:43]: I mean I I'll I'll I I'm not running for anything, but I'm putting stuff in front of you guys and I know as a council you guys could put a force cleaner boards in. We talked the last time with the uh [0:23:43, 0:23:44]: Code enforcement lady, did we not? [0:23:45, 0:23:47]: So get put that in, we'll get it cleaned up, right? [0:23:49, 0:23:51]: That's all I got. Appreciate everybody and all your guys' time. [0:23:51, 0:23:56]: Appreciate your points. We'll we'll t we'll adhere to that. We'll take charge of that and work those things out. Um [0:23:58, 0:24:01]: Who anybody next? Mr. Kenneth Wilson. Mr Wilson. [0:24:10, 0:24:15]: Thank you, Mayor and Council. My name is Kenneth Wilson, three sixty one Vista Creek Drive, Stockbridge, Georgia, Monarch Village. [0:24:16, 0:24:17]: I come here today to discuss [0:24:18, 0:24:19]: A brief non agenda item. [0:24:20, 0:24:21]: For [0:24:21, 0:24:24]: Basically an interim youth program and program development. [0:24:26, 0:24:28]: Just a little history on it. Lest about ten years ago. [0:24:29, 0:24:32]: When the old youth center was still up, I began talking with the former. [0:24:33, 0:24:37]: Former city manager about doing some things that could be a little bit more impactful and cause our city to [0:24:37, 0:24:42]: Бив на берт. Она розтасла сити ют оркестра. [0:24:42, 0:24:46]: Other activities like a robotics teams, things that are really beneficial. [0:24:47, 0:24:48]: А то аркоміні. [0:24:48, 0:24:49]: I'm a local [0:24:50, 0:24:56]: Local social entrepreneur, I run a not-for-profit. I've been in Stockbridge for the last 10 years. Prior to that, senior internal compliance officer for APS. [0:24:57, 0:25:13]: Prior to that, I work with the local CPA, I'm sorry, with a global CPA firm, Fortune 10, so on strategic development. I teach music, piano, and drums to kids. Over the last nine years, our organization has donated cash and income services, close to$100,000 to both the Henry County and Clayton County schools. [0:25:13, 0:25:17]: А бегані с пропозол about ten years or so ago to partner with the city. [0:25:18, 0:25:20]: For ефектив, ефіant. [0:25:20, 0:25:22]: and impactful youth uh development services. [0:25:23, 0:25:27]: Along with uh what you all see in the uh proposal that I sent you is an executive summary. [0:25:28, 0:25:29]: You'll also see a review of our charter. [0:25:30, 0:25:42]: Where I I've made sure that it's aligned that that what can be done is in line with the spirit and letter of what our charter outlines. Also a financial breakdown and showing of how this can be a tremendous savings versus how we approach uh [0:25:43, 0:25:57]: youth youth services currently. Um all of that detail is in there as well. I've also brought another 20, 30 copies of the executive summary. If anyone would like to see it as well, too, they can also email. I believe that this is something that I'll talk to every council member individually on. [0:25:58, 0:26:00]: And I think that everybody is in support of the youth. [0:26:00, 0:26:10]: My big point is this time is that I've been working on it ten years. I know I started and stopped. And it was basically based off of in all honesty, I didn't think that we would be able to come together to do it. But having spoken to you all, [0:26:11, 0:26:13]: My hope and my desire is that you guys can look at it. [0:26:13, 0:26:28]: just for what it is, based off the strength of what the proposal says, the potential savings. And also with us investing twelve to fourteen million dollars in a youth cultural arts center, I think we should be ahead of the game, not necessarily like churches that build life centers and don't have the programs ready to go into it. [0:26:29, 0:26:32]: So the program that I'm offering is an opportunity for us to develop [0:26:32, 0:26:52]: Um, a Stockbridge City Youth Orchestra, robotics teams. I've already spoken to several other local not-for-profit leaderships, some that include um entrepreneurship service of women businesses, others that do robotics specifically, and of course I do music and arts. I'm prayerfully asking that you all would look through all of those things and basically understand in these last 20 seconds that what this is. [0:26:52, 0:27:12]: basically saying is that cities very often provide services by means of facilities. In other words, the facilities Stockbridge currently have, they lease them out for revenue. We don't want to block that up. We're just proposing the city to look at a non-locked up place that we can secure and use that for the base of this program. Thank you. Cam, thank you. And I'll if you just give that to the clerk and clerk [0:27:12, 0:27:32]: make sure we get that and we'll we'll get back to you in a timely manner about the a decision of some type, please. Anybody else ma'am? General. Okay. Okay, on that note, ladies and gentlemen, earlier uh this evening at five o'clock we had uh our ceremonial type of uh review several things that occurred matter of fact it's this is my sixth year being a municipal government and I think [0:27:32, 0:27:52]: This is the first time we had these many types of ceremonies and recognition of activities or special proclamations. And so I just want to highlight uh some of those at this point. Uh I'll start with the Back of School Gold Sponsor Appreciation Awards. Um, this is an initiative uh Council Initiative Mayor Pro uh Tim Blount has was has started. [0:27:52, 0:28:06]: And Public Foods 547 along with uh Sinoca, Rock Quarry Road, and State Farm Agency were all recognized this evening earlier. Heritage uh Hispanic Heritage Month proclamation was issued now to Rico's Mexican restaurant. [0:28:07, 0:28:12]: Mike in uh Garcilia Davis and La Sahenda, a Mexican restaurant. [0:28:13, 0:28:15]: Averta Cornardo [0:28:15, 0:28:23]: If I gotta pronounce right. And also uh a representative for uh Rocio Camacho also received a proclamation as well. [0:28:23, 0:28:30]: Retired Educators Month proclamation was issued to a Cappy Morse. Breast Cancer Awareness Month. By the way, some of us have on pink representing [0:28:31, 0:28:36]: The support for breast cancer awareness and that was um given to Jacqueline McKinsey. [0:28:36, 0:28:56]: And I also wanna mention, uh we'll say this later later as well, that of course uh for s breast cancer survivors we have a luncheon schedule for those individuals on Thursday. So we have to sign up if you're a breast cancer survivor, if you please register for that event. And then on Sunda screaming Saturday morning, we'll have a love walk that'll be at the uh Clark Park. I believe that starts at eight o'clock in the morning. [0:28:57, 0:29:17]: Domestic Violence Awareness Month proclamation recipient was uh Glendora Divine. Uh and then we had eight graduates from the 2019 Citizens Academy here in Stockbridge. Those eight individuals uh uh were really gave great comment compliments in reference to what they learned about the inner workings of the city itself and that aspect. And then of course [0:29:17, 0:29:37]: We had several 2019 BridgeFest sponsor recognitions. Georgia Power, Mrs. Winters, Charles Abbott, Cerna, I believe it's pronounced, Heritage Bank, Waste Industries, Mrs. Savane's Funeral Home, Falcon Design, Carter Sloops, Legacy Ford, and Edward Jones. [0:29:37, 0:29:57]: We're all recognized and supported BridgeFest night 2019. Of course, when we have BridgeFest next year, we'll be in a in a deep into our centennial celebration. Okay, on that note, we have some old business, and that will be public. We have a several public hearings tonight. And uh the first public hearing is a continuation of the public hearing that was. [0:29:57, 0:30:17]: Was held on September 9th. It dealt with council consideration to approve rezoning request for case RZ-2 2019-01, Georgia Healthcare Association Incorporated. Applicant and YM Hospitality Group agent request the rezoning of the property from C2 General Commercial District to C3 head. [0:30:17, 0:30:37]: Heavy commercial district for the purpose of constructing a hotel. Property is identified as and is parcel of ID 051-01028038 and is located east of 160 Country Club Drive. Property consists of 1.268 acres within the land. [0:30:36, 0:30:56]: And lot 20 of District 6 in the city of Stockbridge. Miss Moore, please. Yes, again for good evening, Mayor and Council. This is continuance of the two rezoning cases that you heard earlier, and just a recap of the elements of this as the applicant is requesting from C2 general commercial to C3, which is having commercial. [0:30:56, 0:31:00]: commercial and it is for the Holiday Inn Hotel. [0:31:00, 0:31:13]: And again on the screen it basically shows you uh who the applicant is, where it's located, but the parcel ID is, uh the lot size, their requests, and the proposed use, which is for a hotel. [0:31:14, 0:31:34]: The next slide talks about what is surrounding the particular site. To the north, you have C2 two-story medical office building. To the east, you have a three-story office building with a law firm. To the south, you have a one-story professional office building. Southeast, you have a four-story hotel, and to the west, you have a medical [0:31:34, 0:31:36]: Office building on the site. [0:31:37, 0:31:46]: This is an overview of where the site is located from directional. This is an area view. This is from the east. [0:31:48, 0:32:08]: This is from the West, and here's a land use perspective. Because at some point in time the city of Stockbridge agreed that hotels were compatible in terms of being in close proximity to the hospital, you approved your first hotel, which is a micro hotel which came into the area. [0:32:08, 0:32:19]: Based on that trend, staff and the planning commission felt that this particular proposed use would be consistent with the new land use and the direction of how Mayor and Council wants to see this particular corridor. [0:32:20, 0:32:30]: At the last meeting there were a couple of conditions that you asked that staff uh add to these rezoning and I will put those up on the board for everyone to see. [0:32:31, 0:32:34]: And the conditions are as follows one. [0:32:34, 0:32:41]: That they agree to the site plan as initially received by our office. Two, that the site be used for a hotel only. [0:32:42, 0:32:46]: Three, no weekly or extended state lodging rental shall be allowed. [0:32:46, 0:33:06]: Four, in terms of vehicles that could uh that could stay there, that could not be uh it can only be for passenger vans that actually transport people to and from the airport for their stay. Five, compliance with the overlay district. Both of these hotels actually fall in the overlay district for Eagles Landing to actually comply with the [0:33:06, 0:33:24]: The overlay districts and requirements for the Eagles Landing Master Plan. And six, there's an area that needs restoration of the concrete stairs that were located to the northwest area of the site adjacent to the sidewalk. The applicant is inagreeable with all of these conditions as recommended by Mayor and Council, Planning Commission, and staff. [0:33:25, 0:33:45]: Thank you, ma'am. Questions for the council? Yes. Go write it, please. Uh I think the applicant came in and they were open to doing a high-quality hotel. He's uh he specifically said on the record that he would be amenable to building the hotel as 100% brick and with um a 10-foot wall. [0:33:45, 0:34:05]: Walking path, I think that's required in the uh overlay as well. But if someone comes and they offer that you want the hotel to be a hundred percent brick, I think we should be very acceptant of that because it's a quality project. So um that's something that I would like to see in it, or at least uh the 50% [0:34:05, 0:34:15]: brick requirement that we have um in the uh overlay ordinance. But if it's a hundred percent and that hundred percent was offered to us, I I suggest we take it. [0:34:15, 0:34:35]: Uh, councilman, I think what was alluded to was that um the Eagles Landing Committee had reached out to him and that they had a preference of what they wanted that makeup to be. And his statement was is that if the Eagles Landing uh overlay conditions required a hundred percent, he would not be objectionable to that. But however, he really wanted [0:34:35, 0:34:36]: Wanted to wait and see. [0:34:37, 0:34:57]: What they will require. We automatically have a 50% requirement for BRIC. If the Eagles Landing Master Plans requires more than that, what he was saying was whatever they require above and beyond what we require, he will be willing to do that. That's why one of the conditions we have in here is that they comply with the overlay district of the master plan. [0:34:57, 0:35:13]: plan that gives them that time to kind of work with the group to decide what those uh architectural requirements would be. And then when it comes in for platting, then we would verify with the Eagles Landing community that it meets their requirement in addition to meeting our 50% standard. [0:35:13, 0:35:33]: Okay, so minimally we're looking at fifty percent um minimum and then whatever over the top of that is, that's something that we this council brought to the table specifically. I spearheaded that to make sure that it was in the ordinance. So um the the highway overlay that you uh that we have in place [0:35:33, 0:35:43]: covers Eagles Landing Parkway and you're introducing expanding that, is that correct? That's correct. But this particular prob property falls within the master plan. So there are two [0:35:43, 0:36:03]: Uh guiding guidelines that apply. We have the Eagles Landing Master Plan that covers this property, and then we have a corridor plan, which you are adopting tonight. But what the applicant was indicating is that they would be more than willing to go beyond the 50% based on what the Eagles Landing Master Plan. [0:36:03, 0:36:19]: plan requires and from talking with the representatives from the Eagles Landing community, we feel comfortable that it's going to be above the 50%, but we put the condition in there so that they could work that out and then let the city know what they agreed to so that when the plans are brought in. [0:36:19, 0:36:27]: Then we will make sure that we plat it and build it based on those specifications from the master plan and from the city. Is the applicant here tonight? [0:36:28, 0:36:36]: No, I no I think we didn't didn't require. So are are ch electric car charging stations included, or is that something that's a possibility? [0:36:36, 0:36:56]: Um we have not looked at your ordinance does not require um that we require hotels to have those. It is something that we can pursue. That discussion did not come up at the Planning Commission or at the last council meeting, but it's something that we can ask them about. Uh typically there's a feasibility study that's done whether or not they [0:36:56, 0:37:04]: They want to do it or not, we just never had that discussion. I I would like to see if we could uh ask is at least ask to see whether that is appropriate for that location. [0:37:04, 0:37:06]: Any questions from the Council? [0:37:07, 0:37:25]: Okay, on that note then I need to open this up for a public hearing. All right, so I'm gonna officially call open up for the public hearing here and I'm gonna start for anybody that is for for this particular hotel to go at 160 Country Club Drive in this section over here, please come up and uh speak on that if you're for it, if you want to have any comments. [0:37:26, 0:37:28]: Saying none in the middle. Anybody in the middle? [0:37:28, 0:37:29]: Four. [0:37:29, 0:37:31]: You know, you have somet you have something for. [0:37:32, 0:37:33]: Come on up, man, please. [0:37:41, 0:37:45]: You need your name and address, I believe, right? Is that correct, Clerk? [0:37:47, 0:37:58]: Good afternoon. Good afternoon. My name is Vivian Thomas and I also serve as Commissioner of District 4 where this hotel is proposed to be. I do support the hotel. [0:37:58, 0:38:14]: And I support the initiative of this council bringing forth more industry to the area. I just wanted to ask, and I may have missed this, uh, did you get a landscaping plan from him, that you are or them, that you get a any type of um [0:38:15, 0:38:30]: amenities other than just the basics from this particular hotel as well. Uh will they be adding anything there to uh complement in color and design the hotel across the street and any type of lighting plan? [0:38:32, 0:38:45]: No. Ms. Mor don't you don't go away just yet, Ms. Morgan? Yeah, for those who may not know that the this council adopted a very robust landscape ordinance very early. So it has some of the strictest landscape requirements in the county. [0:38:45, 0:39:05]: Uh so we feel very comfortable that this site will be beautiful. In addition to that, the city adopted a lighting plan, which we think is robust. I think the only issue is whether or not the Eagles Landing Master Plan calls for something more than what we're requiring. And where we are right now is that from talking [0:39:05, 0:39:17]: initially to the representative of the master plan, they did not other than the design in terms of the makeup of the building, what percentage of that should be of other materials based on a standard [0:39:18, 0:39:38]: Scope or design for the typical holiday in to do something different based on what the master plan and the Eagles Landing master plan calls for. But landscaping has been addressed, lighting has been addressed. The only outstanding thing is whether or not your community wants something different or beyond what the count what the city is requiring. [0:39:38, 0:39:51]: Thank you. And may I have a conversation with you later? Yes ma'am. Thank you. Thank you. Thank you. Anybody else for from this section over here? Anybody for uh this hotel that wanna speak on it in this middle section? [0:39:52, 0:39:55]: Okay, my far right. Anybody for? [0:39:56, 0:39:59]: Okay, back over here. Anybody against that wants to make any comments? [0:39:59, 0:40:04]: Far my far left. Anybody against? No, I'm seeing nothing. Anybody in the middle? [0:40:05, 0:40:18]: Amen. All right. All right. So I'm gonna close that public hearing on that aspect. So on that note then I need unless there are any other questions from the council, I just need a motion to accept uh accept this uh going forward with this hotel. [0:40:18, 0:40:22]: Who made a motion? Okay. And who's almost who seconded it? [0:40:22, 0:40:26]: I didn't second I'm co think Councilwoman. You second the motion? Okay, there we go. [0:40:27, 0:40:29]: There's no further questions. All in favor, please indicate. [0:40:29, 0:40:31]: There you have it. Thank you, ma'am. [0:40:32, 0:40:52]: So once again continuation of a public hearing uh from the September ninth as well. This is council consideration to approve rezoning request for case RZ 2019-02. Robbie Moore, applied uh Palace Hospitality L L C applicant representing George P. Harper III, P E [0:40:52, 0:41:12]: Paramount Engineering LLC request the rezoning of property from C two General Commercial District to C three Heavy Commercial District. For the purpose of constructing a hotel, properties identified by its parcel number 051-01028005 as located at 270, excuse me, 2725. [0:41:11, 0:41:31]: Patrick Henry Parkway. Property consists of 3.545 acres within landlot 19 of District 66 of City of Stockbridge. Ms. Moore, please. Again, Mayor and Council, this is a continuance of a public hearing that was held some time ago. Rezoning 1902, 2725, Patrick Henry Parkway. [0:41:31, 0:41:51]: From C2 general commercial to C3 Heavy Commercial for the True Hilton Hotel. Again, this particular slice actually shows the community who the agent, the location, the parcel ID, the lot size, the proposed uses for a hotel, the fact that it's currently vacant, the future land use, road access, and when the signage was posted. [0:41:51, 0:42:10]: The next slide basically shows what surrounds the proposed site. To the north is C2 is vacant land. To the east is a PD is vacant land. To the south, PD is vacant land, and to the west, C three is vacant land. As you know, this particular project is in close proximity to the one that you just approved. Here's an area view of the site. [0:42:12, 0:42:15]: Here's a sight view to the south. [0:42:17, 0:42:19]: Here is a site view to the north. [0:42:21, 0:42:29]: And here is the land use plan. As we mentioned before, the city at some point in time felt that this particular corridor was um [0:42:31, 0:42:51]: open to a change that would allow hotels due to the proximity to the hospital. So therefore you allow the first one, you just approved the second one. This will be the third one in close proximity to that particular site that you just approved. In terms of conditions, staff did go back and add some conditions to this particular site. [0:42:51, 0:43:05]: Basically uh the conditions that were added was to make sure again this particular project falls within the overlay district of the Eagles Landing Master Plan. And so therefore the only other condition that we added [0:43:05, 0:43:07]: Was that this particular development? [0:43:07, 0:43:11]: lines up with the expectations of the master plan, which means [0:43:11, 0:43:19]: that if they require more than the 50% that we currently require, that they would be willing to do that. And the applicant indicates that they are. [0:43:19, 0:43:33]: Okay. Questions for Miss Moore, please. Yes. Are you okay? Back to you that was going to go right in. Talked about this the last time. Does the applicant have a picture of what it is supposed to look like? So it's very important that it it fit in. [0:43:35, 0:43:51]: I think at the last picture he uh at the last meeting he actually brought some of those. We did not upload it. Um, but they are the traditional true Hilton styles that exist in the area, which are very nice. But before the meeting is over, we can go find that picture and upload it. [0:43:51, 0:44:11]: Right. We also discussed, as you said, with the other one that the ten foot walking path will be included on this project as it as that's what we anticipate uh would be along Patrick Henry Parkway because we want to uh enhance the health and wellness community. I would like for you to go a little bit more detail. Folks might wonder why it's advantageous [0:44:11, 0:44:21]: to the community to pro improve these hotels. Can you talk about the benefits of the hotel motel tax so folks can understand the benefit to the community in revenue? [0:44:22, 0:44:40]: Okay, well um as mayor and council know we don't have a municipal tax, so therefore we rely heavily on other funding sources. Hotel motel tax is one of those revenue streams that the city relies heavily on to do tourism and other things that pertains to the city of Sidebridge. And as you know, the more hotels we have [0:44:41, 0:44:47]: the more monies we have in that fund account that allows us to do things to help the citizens of Stockbridge. [0:44:48, 0:44:48]: Okay. [0:44:49, 0:44:51]: Any other questions for Miss Moore? [0:44:51, 0:45:11]: Okay, before I open up the public hearing, I forgot something earlier, ladies and gentlemen. If you're a gentleman in the in the chamber, uh be more respectful if you can, could you please reflect take off your cap? If you're a gentleman, we'll appreciate if you take off your cap. Thank you very much. On that note, I'm gonna open up the public hearing and I'm gonna start on my on my very left over here. Anybody [0:45:11, 0:45:17]: Anybody for for this and wants to speak, that's for this particular hotel, true Hilton. Anybody for on this side? [0:45:17, 0:45:18]: Yes, ma'am. Come on up. [0:45:20, 0:45:21]: Name and address, please. [0:45:30, 0:45:39]: Again, Council, thank you. My name is Vivian Thomas, one oh seven Bay Berry Hills and I also serve as commissioner of district four of this area. And I do support this um [0:45:40, 0:45:51]: this hotel coming to the area. I have one question and the question is I notice that this particular hotel will occupy three point five four acres versus the other hotel will occupy [0:45:52, 0:46:12]: One point six eight acres. Are are they about the same size? Is the second one a little bit larger? And if not, have you put restrictions on what the balance of the land will be used for or how it can be used? Okay. Uh no, basically each hotel has their own specs in terms of what they want to bring. A true Hilton because of [0:46:12, 0:46:32]: This design has a certain number of rooms holding in because of their design chooses to do another type in terms of the number of rooms. So the city doesn't have a requirement. This these particular properties, as you know, actually are in a high-rise overlay district, right? So they're consistent in terms of the minimum number of stories that they're supposed to have. [0:46:32, 0:46:52]: They haven't capped out so that there's nothing in the high-rise overlay district for the city or in the overlay district that we have or in your master guidelines that require us to tell the developer what he can do with the unused land. All we can do is pertain to the zoning. As you know, uh adjacent to that property is a [0:46:52, 0:47:12]: A strip you may or may not know, but there is a um it's adjacent to another parcel that's being developed with this applicant and someone else that deals with possible Penora bread and some others that come in that connects to that. So there are some land issues that will be resolved when that particular development comes in. But we're not allowed to restrict what he does with that property. [0:47:11, 0:47:14]: property other than the zoning which is before us. [0:47:14, 0:47:34]: Thank you. Just hopeful we can make some additional requests that just may help make that area even more beautiful for the hotel that's there. And there again, I know you can't require it, but if they can add some type of conversation parks uh in the area just to make it more livable and more adaptable to the area. I think that's requests. I think that's where uh [0:47:34, 0:47:54]: Councilman Alexander has asked for the walking paths. So all of our developments actually call calls for connectivity so that individuals can walk and enjoy the developments as well as the rest of their community as they move from the residential to the commercial nodes. They're walkable, they're bikeable, all of those wonderful things. Thank you so much. [0:47:54, 0:48:03]: Thank you, Council. You're welcome. Once again for this section. Anybody else for in this very my very left side. Don't see anybody in the middle. [0:48:05, 0:48:11]: Anybody on the far my far right. Okay, any comments over here f uh against this hotel coming in? [0:48:12, 0:48:13]: Anybody in the middle? [0:48:13, 0:48:15]: Anyone on this side? [0:48:15, 0:48:17]: I see none, so I'll close that public hearing. [0:48:17, 0:48:29]: Uh council, I need a motion to s uh go forward and accept uh this continued construction of this hotel. Mayor. Yes ma'am. I move that we move forward and accept this construction of this hotel. [0:48:30, 0:48:50]: Sir second? Second. Second is Mr. Thomas. For the questions, if not, I'll have a question. Yeah, I just want to reiterate what I uh emphasized on the holiday end to have a discussion about the electric car charging stations as we move forward to be more environmentally friendly so we can start moving in that direction. [0:48:50, 0:49:10]: Correct and uh councilman after this meeting we'll have a conversation with them, both of them tomorrow. All right, thank you. Okay. You have something else, ma'am? Okay, all in favor, please indicate. Thank you. Appreciate that. New business, public hearing, council consideration to approve ordinance amendment, Title IX, licensing and regulation to establish interim standards pertaining to [0:49:09, 0:49:29]: To certain businesses impacted by the current moratorium with either numerical limitation or distance of separation. Ms. Moore, please. Yes, uh good evening again. Uh as you know, for the last two years, uh Mayor and Council have had uh to deal with the issues of licensing to all of its businesses. And so your concern. [0:49:29, 0:49:49]: Concern was in terms of making sure that we did not have an oversaturation of certain businesses, and you chose to put a moratorium in place until we could begin to figure this out. And so, like a lot of other jurisdictions, not just Stockbridge, we looked at other jurisdictions and said, What are some of the issues or businesses that maybe oversaturated? [0:49:49, 0:50:09]: Saturated in your community and whether or not they should be added to the list. So therefore, uh you were brought a list, you issued a moratorium, and that moratorium was in place until we finally have a rewrite of the zoning ordinance. Um so in order to to remove the moratorium, put legal draft and what is before you tonight. [0:50:09, 0:50:29]: Is how we want to deal with particular businesses to make sure that they are allowed, but to make sure that they're not adjacent to one another, and to make sure that there are some distances between them and regulate the number of those businesses that could be allowed in the city of Stockbridge. So section 9.105 is the purpose. [0:50:29, 0:50:49]: And the first classification deal with the numerical limitation on certain businesses. And this code section shall apply to the following types of businesses: tire shop, vapor shop, thrift stores, and consignment shops, used appliance shops. And basically, what this says is that there is a numerical limitation. [0:50:49, 0:51:02]: to just how many of these you can have in the city of Stockbridge based on your population, right? If you've only got, you know, thirty thousand people, do you want thirty thousand of these? Um and so with this particular um [0:51:02, 0:51:18]: Section does, it means that you can allow, you will allow these, but it's based on a certain number to ensure that saturation of these particular type of businesses do not occur, that there is a balance in your business community of the type of communities that are allowed. [0:51:19, 0:51:39]: The second section deals with spacing. This coat section shall apply to the following types of businesses. In other words, this is hair salons and barber shops, nail salons, tire shops, pawn title lending and cash for title shops, vapor shops, thrift stores and consignment shops, auto shops, user plan shops, and tattoo shops. [0:51:39, 0:51:59]: It gives a mile radius. So basically what it says is that these are allowed. However, from point to point, that you cannot we will not issue a business license if you are closer than a mile within a mile radius of another business just like yours. So if you're a tire shop and you come in, the first thing that we're gonna do. [0:51:59, 0:52:19]: Is look at where your tire shop is located, and then we're gonna find out where the next tire shop is located. And then if that is beyond a mile, then you're saying that we can issue the license. If they are within that mile, then we're gonna tell them that we're unable to issue a license at that location, that they will have to find another location. [0:52:18, 0:52:28]: Location for the issuance of the license, which is beyond the one mile radius. And that is the ordinance that have been drafted before you tonight for your adoption. [0:52:28, 0:52:48]: All right. All right. On that note, uh council, questions. Yes. Go write it, please. Uh well I have a concern. Okay. I would prefer the pawn title ending and cash shops to be limited as well, not by mileage. Is there an issue with that? [0:52:50, 0:53:10]: Uh on the num numerical terms? For for for purposes of this particular ordinance, um we're not changing that piece, um, but we are imposing the limitation in terms of spacing. Okay. Thank you. Ms. Alexander. Yes, I w first of all I want to say thank you, Ms. Moore, and thank you to the entire staff. [0:53:10, 0:53:30]: You've done your due diligence on this particular entit um initiative of the city. I think our s our residents are are tired indeed tired of having tire shops, uh auto repair shops, different types of businesses that saturate our community. And you've done the work. [0:53:29, 0:53:49]: And we want to make sure that we have a variety. We're not against any particular business itself. We just don't want those businesses to be um saturated in the area. And I think you've done the due diligence and the work to make sure that we have a correct balance uh in the city. And we want to uh folks [0:53:49, 0:54:09]: To understand that you know we have standards in this community and that we want those standards to be reflected in terms of the businesses that we have in the community. Now, as far as this list is concerned, um the one there's a key issue here uh in the community and in the nation right now. I don't really want the value. [0:54:09, 0:54:29]: Vape shops to be removed from the from the moratorium. I think we should do everything else, but I think we should leave the vape shops in the moratorium because of the critical health issues that we're seeing every day with young people dying. I think I'm for this particular ordinance, but I think we need to uh keep a cap [0:54:29, 0:54:36]: Yep, we're right where we are on the vape shops until the the public health issue has been dealt with. [0:54:38, 0:54:51]: Go go right ahead. My understanding and this would need to be confirmed, but we are already at our limit for vape shops in um based on the ordinance, so you couldn't get any more in the city based on what it says right now. [0:54:52, 0:54:55]: Okay, good deal. Any other questions from the council? [0:54:56, 0:55:08]: Mayor. Yes, ma'am. Um I agree with Councilman Alexander and and just so people know what we're doing here, the just so the citizens are aware, uh you know, we want to [0:55:08, 0:55:10]: Of course be business friendly. [0:55:11, 0:55:31]: But we also want to make sure, and we've heard from our citizens, and we want to make sure that we have a variety. Um we can go down the street and there are four auto stores, two across from each other, two on one side, two on the next, two tire stores right side by side. And we want a variety. Um we don't want to become [0:55:31, 0:55:51]: Saturated with the same stores. I don't see on here, I know we have an ordinance in place that we adopted for dollar stores. And so we're just it we're using that particular ordinance. Is that correct? Okay. I think it's a I think what we're doing is great because it lays out what we want our city to do. [0:55:50, 0:55:57]: to look and feel like and what we've heard from citizens. Um so thank you. [0:55:58, 0:56:14]: Counseling other comments? Thank you, Mayor. I my question is we had an applicant. I just want to make sure that we're we're okay with this applicant on his request before we move forward with this. Because I made sure that I asked with the applicant that kept coming before us. [0:56:15, 0:56:25]: I think when uh the mayor opened up for public hearing, I think he's here to speak on that. Okay. So when we open it up. Yes, ma'am. Any other comments from the council? If not yes, you good? Okay. [0:56:26, 0:56:31]: If not then I'll open up for public hearings. So everybody's in for this particular ordinance that's as you know it. [0:56:31, 0:56:35]: The far my far left side. Any comments on far left side? Four. [0:56:36, 0:56:37]: In the middle, four. [0:56:38, 0:56:41]: Fine, far f four. Come on up, sir. [0:56:42, 0:56:43]: It's short that is good. [0:56:44, 0:56:46]: Yeah. Name and name and address, please. [0:56:49, 0:56:49]: Thank you. [0:56:53, 0:57:13]: Um my name is Andrew Dixon, 213 Ernestine Way, Stockbridge, Georgia, 30281. I was requesting um I put a uh a presentation together um for my company and the proposed location and the due diligence that I've done with the city and stuff as far as like the public records requests that I've done. Um about a five to seven minute presentation, if that's cool with you guys. [0:57:14, 0:57:34]: Well, first of all, uh typically I don't know if we typically do probab uh uh presentations like that, but if if that's the desi I guess the desire of the council, if they want to uh if you wanna actually see a presentation that he has for this or not. I guess my yes, ma'am, go to my question, Mayor. Uh you're for this? Uh and you still wanna do a presentation? Uh I'm I'm for it. [0:57:33, 0:57:53]: for for the understanding that there are businesses on there that are overly saturated, um like I said, I I did do public rec records requests. Um as far as it goes with my business and the type of business that I'm trying to open up, um I w uh my concern is the is is what I'm gonna fall in with the um distance requirements. Um so there are some things that I do agree with and some things that I don't agree with. So I don't know exactly [0:57:53, 0:57:56]: how to fall in with that. But um [0:57:56, 0:58:16]: Well, first of all, this is four, but also in the ordinance, it it would talk about d uh distance requirements. I mean so a lot of that would deal with the fact of where where the business is going to be compared to other businesses like businesses yours. So the the the question at hand is is um if the ordinance was to be passed and if it had if it included outside of the city, so um if we if the ordinance [0:58:16, 0:58:36]: was just included like let's say if inside of the city limits and it was like uh the mile gap is limited to like businesses in the city, then I'd be okay. Um if it ends up being that it's included outside, which includes like unincorporated areas, like um there's a there's a studio that's a little bit under the mile, that would basically like put me out and I wouldn't be able to do it. And [0:58:36, 0:58:56]: There's basically like no other really good places. Um it's been a back and forth. I've been really patient, like four to five months. One second. Uh for the ordinance I was saying I understand it's within the city limits as I thought, but I don't know. Clear me up, clear me up here. As written it applies both within and outside. Okay, there you go. And that was intentional given how our boundaries are. Okay. Sometimes we don't know what we're doing. [0:58:56, 0:59:08]: who's in or who's out. Okay. But you know the the the actual limitation of a mile, you know, there there's some flexibility there if the council wanted to to work with him on that. [0:59:08, 0:59:14]: All right. I think if I may, uh Mayor, I think in in my most recent conversations with Mr. Dixon [0:59:14, 0:59:19]: That he had identified a property and that property was a mile away from [0:59:19, 0:59:39]: any of the other uh tattoo parlors in the city of Stockbridge. However, his location is about I think six or seven tenths a mile away from a um business in unincorporated Henry County. And I think uh for Mr. Dixon, I think that was the um challenge for [0:59:39, 0:59:43]: for him based on the location that he's identified at this point. [0:59:44, 0:59:54]: All right, but by the ordinance right now where it's written, if we pass it it has to be with it has to be outside of a mile, in or outside the city limits as as well. And that's the way the ordinance reads at this point. [0:59:55, 1:00:00]: Okay. All right. Any other thoughts on this end? Yes sir, go ahead, please. Um [1:00:00, 1:00:05]: The thing that I want to mention is the the number of [1:00:05, 1:00:11]: shops is your particular shops and and it's definitely not an oversaturation. Um [1:00:13, 1:00:24]: It's up to this council for us to allow you to do a five minute presentation. Uh for me personally, uh just the fact that we're not oversaturated. [1:00:24, 1:00:44]: And I just heard the conversation about the distance. So if the distance satisfies you in the location where you are desiring to get, I don't know if we even really need to to go down that road. And I'm saying that because there's a lot. And if everybody comes up and they are requesting [1:00:44, 1:00:48]: and five or ten minutes each, then I I think we got a problem. But [1:00:49, 1:00:57]: Um I'm satisfied in my mind and in my heart where I am on the vote. So for me, I I'm I'm not sure if you need it. [1:00:57, 1:01:01]: To to to present that but you want to you want to see the pres presentation you're saying? [1:01:02, 1:01:22]: For me, I don't need it. Okay, I got it. All right. We typically don't do that. But unless the council wants to unless I got a consensus for him to see the presentation, uh we'll forego that. If I got a consensus, we'll do it. If not, uh we won't. Yes sir. Yeah, do you have something, sir? Please. Yeah, once you know, if this is passed, uh if there's any [1:01:22, 1:01:27]: um circumstances that needs to come back to the council for [1:01:27, 1:01:31]: uh approval that's outside of the boundaries that we're voting on tonight. [1:01:32, 1:01:52]: Then those can still come back to the council for consideration. Um I I don't want us to set a precedence to have, because if we allow you to do a presentation, then it then we we've set a precedence for these public hearings. If you have a um unique situation with the city and you bring that back to the city, [1:01:52, 1:02:12]: You can bring it back to the count to council for considerations once this is approved. Is that my that's my understanding? We go back to the appealing situations to the council when it comes to that uh that type of situation. So on that note, it seems as though if you have additional comments for, you can make those comments. It seemed like we're not going to [1:02:11, 1:02:14]: approve the actual presentation tonight, okay? [1:02:14, 1:02:34]: Um all right. Anything else you need to say, sir? Yeah, so um basically like I said, um I am 100% um for the moratorium because there is some certain businesses that are um that are definitely oversaturated in the city. Um to put tattoo studios in there. Um like I I I did a public records request and I finally got the answer back because I finally got the right words out. [1:02:34, 1:02:54]: Um and basically it was um to get how it was con how the list was constructed and what data was given. Um so basically what I was informed that uh that she was mayor pro tem at the time, uh Ms. Gantt, basically she was the one that that proposed the list. It was unanimously unanimously voted for forward or nothing. But the requirements were when that when that was passed, was that additional information was given. [1:02:54, 1:03:14]: Given to support the moratorium, and the additional information was supposed to be given to the council by business services, which never happened. And I have that on email from Public Service Records from Miss Camilla. It says it never happened. So there's only two tattoo studios that fall in the city limits. One is Noble House, which is on North Henry Boulevard. The other one is uh Jolly Rogers. [1:03:14, 1:03:34]: Which is on Rock Quarry Road. So that's not we're saying only two tattoo studios is being considered right now to be put on this list and under this ordinance as oversaturation, which I don't agree with. And I and I respectfully, you know, it's nothing against. We've been at this for a few months now, but I still can't understand other than the fact that it might be the old stigma of the tattoo studios, why it's even [1:03:34, 1:03:53]: On the list right now. Um, if we like I've I've done research. I got a uh a 1500, like we we were going back and forth. I printed out a stack this big of business license, I went and highlighted. I could tell you other businesses that should possibly be on there, like insurance firms, like State Farm, all states, farmers insurances, like they they outnumbered businesses in the city by [1:03:53, 1:04:13]: A lot. Forty forty nail salons, you know, twenty twenty, you know, hair salons, barber shops like Oh, Mr. Dixon, okay. And and your your position. But I'll tell you what, I'll tell you what I think we understand you. All right. I think we understand you. But uh outside of that, no, sir. Uh we'll see what what the council decides to do with Jesus short. [1:04:13, 1:04:26]: All right. Awesome. Thank you. Please please say have you seen anybody else from the middle section four? Anybody for from the far on my far right? Anybody against uh this uh ordinance uh on my left or far left? Anybody? Anybody in the middle? [1:04:27, 1:04:47]: Anybody from our far right? If not, no great. Then I'll close off the public hearing. Any additional comments you have to say, ma'am? Yes, I would uh I think mayor and counsel would have to um somehow deal with it separately. If if my understanding, the ordinance that adopt that you adopt tonight, he will have issues with because he's [1:04:47, 1:04:57]: not that mile radius leads over into uh the county. So if you adopt this, I think what he's asking you to do is separately so that you don't [1:04:57, 1:04:59]: set a precedent [1:04:59, 1:05:09]: Is to adopt the ordinance and then deal with his situation case by case. I think that's what he was asking. Okay, we can do that. Is that what you were asking? [1:05:09, 1:05:15]: Okay. Oh okay. I we got you. We we I think we understand. [1:05:16, 1:05:21]: Anything else you need to say, ma'am? I just wanted to make that clarification. Thank you very much. Anything else from the council? [1:05:21, 1:05:26]: If not, then I need a motion to accept the ordinance, please. So move. Is there a second? Second. Second. [1:05:27, 1:05:27]: Bonne. [1:05:27, 1:05:31]: Give Ms. Gantt give a second. All right. All favorite orders, please indicate. [1:05:32, 1:05:34]: No case unams, thank you very much. [1:05:34, 1:05:54]: Number six, public hearing. Council consideration to approve amendment of zoning conditions of RZ-16-30-S. Jericho Crossing Zone Plan Town Development to adopt design standards. Ms. Moore, please. Yes, uh good evening again. Uh long awaited Jerodico is here. [1:05:55, 1:05:58]: Um and so staff has um [1:05:58, 1:06:11]: tediously gone back and forth on the design guidelines. We've met with all of the parties involved and so staff brings to you tonight the design guidelines for the Jodico project. [1:06:12, 1:06:32]: And uh the applicant is here. There's only two areas of disagreement as we move forward in this 50-page document. Um, and that is on the transitioning end of the commercial versus the residential, and on the [1:06:31, 1:06:51]: Width of the multi-use pass. The particular document has been posted online for the citizens review. Um, and I would just hit the highlights. Uh, this is what the development calls for. It is 158 acres, and they're divided up into these pods. Pod A is a single-family detach. [1:06:51, 1:07:11]: Which is 12.1 acres, which is 7% of the site. Part B is divided up into two, B1 and B2, which is single family attach, for 15.7 acres, which is 9% of the site. Part C is single-family detach, which makes up 32.6 acres. [1:07:11, 1:07:31]: Which is 20% of the site. Pod D is multifamily apartments, 14.5 acres, which is 9% of the site. Pod E is the town center, which is the downtown, which makes up 13.3 or 8% of the site. Pod F is strictly commercial, C2, C3. [1:07:31, 1:07:51]: Which is uh 39.1 acres, which is 23% of the site, and then Part G is basically open space. Uh the only areas that we have some disagreement is on uh at what point does these particular parts come online. Uh staff [1:07:51, 1:07:54]: And the planning commission had recommended that [1:07:54, 1:07:58]: There's a fifty fifty percent ratio that um [1:07:58, 1:08:18]: 50% of your residential and then 50% in commercial, and then you go back to 50% of your residential. And then on your multi-use paths, we pretty much adopted Henry County's overlay, and Jody Cole lies in the overlay district for the highway in terms of the multi-use paths. And so forth that we adopted that with 12. [1:08:18, 1:08:28]: And the applicant is recommending something else. So uh what the applicant is recommending, which is con which is different from staff recommendation, is that of the [1:08:29, 1:08:39]: There are, let me back back. The DRI, which is Development Regional Impact Study, is only allowing them to have six hundred and sixty residential units. [1:08:40, 1:08:57]: And of those residential units, the applicant is gonna bring your proposal tonight uh to allow him to bring in four hundred and fifty-one of those six hundred and sixty. And that would equate to pod A. If you can see it up there, I don't know whether. [1:08:58, 1:08:58]: Yeah. [1:08:59, 1:09:08]: Okay, uh pod A right here would be 61 homes, pod B one [1:09:10, 1:09:11]: Which will be condos [1:09:13, 1:09:15]: Which is ninety. [1:09:15, 1:09:17]: And then part D [1:09:17, 1:09:24]: Which would be three hundred units of apartments for a total of four fifty-one of the six hundred and sixty. [1:09:25, 1:09:45]: Uh on the multi use pass, it's basically from twelve to eight. Don't know if it would make that much of a difference. I think eight foot is wide. I think we agreed to that. We just adopted what Henry County has, but I don't think there's a lot of hardburn between twelve and eight. But I will let the applicant speak to those. But again. [1:09:44, 1:09:57]: This is Jody Cole, 50-page document. It's online. The applicant is in agreement with everything that we've presented other than when the commercial comes online and a decrease in the multi-use pass. [1:09:58, 1:09:59]: Can thank you. [1:10:00, 1:10:04]: Council, any questions for Camilla before we bring the applicant up? Yes. Go right up please. [1:10:04, 1:10:12]: Um, so let me understand, you're basically stating that the commercial will come after the residential. [1:10:12, 1:10:16]: It depends on if you're looking at the staff proposal, what we [1:10:16, 1:10:21]: The staff and planning комісін um were suggesting just to make sure. [1:10:21, 1:10:41]: There were some concerns that we really wanted to make sure that the commercial came on board. Right. And so, therefore, for us, a trigger, the only one that we can think of, was that if you allow a certain percentage of residential, and then you go to the commercial, and then because they couldn't do as much residential, it forces them to do the commercial, which allows them to do that and then come back to residential. [1:10:41, 1:11:01]: residential. And so we base that base on the units and the density as it compares to the commercial acreage. And so that was what we recommended. I think what the applicant is going to speak to you about is how this development works in terms of what they propose and of the 660 [1:11:01, 1:11:10]: Units, they actually wanted to bring in parts A, B, 1, and D for 451 units, and then he's gonna tell you. [1:11:10, 1:11:19]: when he speaks how he plans to bring on those commercials. But I'll I'll let him do that. I was just sharing with you the difference in terms of the recommendations and how we got to where we were. [1:11:22, 1:11:25]: One second, you done please? Mr Mr. Blount, go right, please. Okay. [1:11:26, 1:11:35]: Um thank you. We we sat in a meeting uh for several hours going over the dynamics of this project. [1:11:35, 1:11:47]: And one of the things that we all came in agreement with that you gotta have foot traffic, you gotta have people in order to patronize any commercial entity that you bring in within any project anywhere. [1:11:47, 1:12:07]: And so to establish that, this is why I agreed to the residential piece. And I still agree to it. Um one of the things I've always stated is that when we hire staff, those we listen to recommendations, but we also listen to what makes sense uh when something is outside of our field. And one of the things that have been [1:12:07, 1:12:27]: Nodd h head nodding, yes, is what makes sense is to bring the residential piece in in order that we establish a foundation of those things that is needed for the commercial piece. Uh when we look at this in in its totality, uh when we talk about acres and we talk about uh light density, high density, and all those different technical [1:12:27, 1:12:47]: Airs and and the citizens can look online at at that fifty uh fifty or fifty one page document. Um I was uh I will rest assured in that meeting with uh our city manager, our city attorney, and uh others that was in that meeting that this move for residential to um be placed first prior to [1:12:47, 1:12:52]: the commercial is a good move because who would wan if I'm gonna build [1:12:53, 1:12:56]: commercial, I wanna make sure that the traffic is there. [1:12:56, 1:12:58]: The elements are there for us uh [1:12:58, 1:13:00]: Uh um I'm sorry. [1:13:00, 1:13:20]: The residential is there uh and and the traffic piece to uh uh make sure that that we're the traffic piece is also being put in to make sure we're funneling traffic in and out of the area correctly and we're we're right there next to the interstate. I think that this is heading in the right direction and and and I think that and I'm supporting [1:13:20, 1:13:29]: important it tonight because I think it's when sitting down at several meetings and what we've come up with with this project, I I think it's a I think it's a win for the city. [1:13:30, 1:13:32]: Mr. Abbas Henry. [1:13:33, 1:13:53]: I concur with Mr. Blount, I really do, that uh this particular development is that you need foot traffic on the particular location and the type of uh development as we will hear from the applicant, uh I I've been told is is supposed to be something that uh is transformative for the area and something [1:13:53, 1:14:13]: Things that on a higher level that will actually attract the type of business that we want in the community. I think what we want to see is we want to see some higher-end commercial. As a realtor in the area, I think one of the dynamics that we miss. [1:14:13, 1:14:33]: Miss here is that we miss some of that live, work, and play. And in the live, work, play concept, folks want low maintenance, but they want high-end trims to go along with those condos and those townhomes, but they don't want two-acre lots. They don't want acre lots. They want to be a nice home, but they don't want [1:14:33, 1:14:53]: And I think over time, with the dynamics and the market uh we're in right now, I don't have any doubt that the commercial is gonna follow very strong. It will be there, it will be present, and it will deliver the types of development. And honestly speaking, I think I can speak. [1:14:53, 1:15:00]: speak for most of the community, we want to see something happen there. And we want to see something happen major. And I'm ready to move forward. [1:15:01, 1:15:07]: Any other council comments right now? If not, then could the applicant come forward and and answer any questions the council may have? [1:15:11, 1:15:12]: Please introduce yourself, sir. [1:15:15, 1:15:35]: My name is John Palmer, uh, 1611 Avery Drive, Locust Grove, Georgia. Uh I'm uh the applicant's representative. I work for Falcon Design. Uh we've been doing on the engineering and planning on this project for a long time. Uh it's been going on, and uh we are very excited the applicant is actually here. [1:15:35, 1:15:55]: Here, the owners here. He's very excited as well to move this project forward, and we appreciate your availability as a city council to work through this process. We appreciate the staff for also working with us so diligently. It has been a long and arduous process, lots of details in the development. [1:15:55, 1:16:15]: Development agreement. I can tell you the applicant is very invested in this project and has already put about six and a half million dollars into the infrastructure through grading, through water lines, sewer lines, through roads. We've already designed the East-West Road and submitted it. [1:16:15, 1:16:35]: We've already designed the parkway through the middle. It's ready. We've already designed some of the other road networks and other sewer networks. We're just waiting on this last final step to make it so we can get started moving some dirt again. The only differences that we had that are very minor, and you guys have spoken to it, and I'll give one. [1:16:35, 1:16:39]: [4600.0, 4620.0]: And uh being that we th d the owner's already spent so much money and time and energy investing in the utilities on this project, the grading on this project, the road networks, uh he's requesting to get that foot traffic. So uh he's asking for seventy percent uh of the total residential units uh can be developed prior to the development of the commercial. [1:16:59, 1:17:19]: His goal is all of it gets developed at once. You make more money when it all goes fast. So that's the goal. And then the last thing was the multi-use paths. As Ms. Camilla stated, that's a 12-foot multi-use path, which was kind of the county's direction they were moving. Here we're wanting [1:17:19, 1:17:39]: It to be more of a mixed-use town center, so we're proposing eight-foot multi-use path, which is actually a size of a cart path that you would see. Um, and they are very large uh on both sides of the road. One one road, if I could point out, this road here is the main parkway road, and it will have a large, larger than eight-foot path. Uh [1:17:39, 1:17:56]: on that that connects and runs laterally through the middle of the community. But again, we're very excited about it. Uh fantastic to be at this final point uh with you guys. Thank you so much for being patient and working with us. Uh and uh we're ready to move some dirt. So [1:17:56, 1:18:16]: Council, any questions here? Yes, ma'am. Go right in, please. Yes. During our meeting we discussed um the pathways. Right. And uh the what you pointed to was the parkway going through and we also discussed going across, correct? And and and on the outside, I mean [1:18:16, 1:18:28]: From but not the within the pods basically. Correct. So So everything would be twelve feet and then the pa inner walk space would be eight. Is that not correct? [1:18:29, 1:18:49]: From what I understand, this road here, which is the main road, uh, is it has a condition on it from the Georgia Regional Transportation Authority. And that's the big one, yeah. These are in the north south, yeah. These would all still have the big eight foot cart path on both sides of the road, here, here, and then there. [1:18:49, 1:19:00]: Inside the pods, um inside the subdivisions would be the smaller standard five actually bigger than standard is a five foot path uh inside the pods themselves. [1:19:02, 1:19:05]: But not on the the main roads are the big cart path. [1:19:06, 1:19:26]: Mayor. Go right, please. Uh Ms. Moore, can you give me the recommendation of the city for those sidewalk paths so I can see the difference, please? Okay, the city, what we did is that uh you adopted Henry County's overlay district, which was twelve. Um, and so we just adopted those when we brought the highway corridor before you, which included Jodico. Um [1:19:26, 1:19:40]: We're fine. That is I mean we didn't get the rationale why the county did twelve um because they're the county. Uh we just adopted those. We thought they were reasonable, but for this type of development, I mean staff and planning commission really didn't have heartburn about it. [1:19:41, 1:19:45]: What we were trying to do is show a good faith effort to the county to set you had it. [1:19:45, 1:19:54]: We went with it, but it's not necessary. Something else is suitable, particularly along the major thorough thoroughfare where the DRI actually requires ten and not twelve. [1:19:55, 1:19:56]: One one second, you you're done? [1:19:56, 1:20:09]: Well, you said the main thoroughfares, but what about the other w what was your recommendation in general of all of all? Your ordinance is twelve. My ordinance is twelve. Yes, ma'am. Your ordinance is twelve. Okay. On any of them. [1:20:10, 1:20:14]: And and and this was just not Jodico, but it was for all the property. [1:20:14, 1:20:34]: Uh along the Jordi Co corridor. Um, not quite sure that when all this came together, they were looking at a mixed use like this. Uh, but in our agreement, when we adopted the ordinance, we gave some assurance that we would try to adopt it as much as we could when it works. And what we're saying is that we put it in there. [1:20:34, 1:20:54]: that's because that's what your ordinance has and we don't as staff we don't have the authorization to change it from 12 to what he's recommended but what staff will tell you is that we don't have any issues with it going down to eight uh and the 10 based on the DRI based on what the DRI required and what they're proposing. [1:20:54, 1:21:14]: couldn't change the ordinance because that's what you adopted. Sure. Honestly, I do have some heartburn with that one because I think the Path Foundation is the preeminent trail builder in Meth Metro Atlanta. They build 200 miles worth of trails. They build them all at 12 foot. That is the standard. The Atlanta Belt Line, I think that's [1:21:14, 1:21:34]: That's 14 foot. We don't want to take a step down. We want this development to be a best in class development in every single way. And we want to match that because we hope to uh have a 10-foot uh connected to 10 to 12 foot connected pass system throughout this throughout the city uh with the master trail. [1:21:34, 1:21:54]: plan that we passed in twenty seventeen. Now um as far as this is concerned, I think this was a part of Johtoco North, Johako South. This was a lot of extensive work done what by the Atlanta Regional Commission or or was it was ARC that did the work? I think I [1:21:54, 1:22:13]: you know, I i I've I wanna honestly say I think the state kind of ignored Henry County. I mean, um I mean when they came in and they did less, I mean they required less along the major connector. They didn't do twelve, they required them to do ten. So what we're saying is that from a staff perspective [1:22:13, 1:22:33]: We adopted the county's ordinance, which is 12. What we're also saying is that the state is only going to allow them to do 10 along the major corridor. And for us, we do not have a problem with the eight simply because it is a walkable, mixed-use community and which is varies, and as long as you have your [1:22:33, 1:22:42]: wider paths along the major thoroughfares, then it's fine. But what it speaks to is beyond the major thoroughfares that deals with internal. [1:22:42, 1:22:54]: And and staff it's like we don't necessarily disagree with the applicant, but again, because it's your ordinance, we can't change that. You have to change that, but we don't have any issues with internally. [1:22:54, 1:22:57]: It going down to eight, but eкsterna. [1:22:57, 1:23:01]: keeping what the state has required, which is the ten foot instead of twelve. [1:23:01, 1:23:21]: Well, see, this is the issue. That's what Henry County asked for was the ten feet. They should have asked for the twelve. Oh, they got what they asked for. They really should have asked for twelve in the beginning. If they would have asked for twelve, they really would have gotten that. The G Dot went on the recommendation that they actually had. So what I'm actually proposing is that we maintain [1:23:21, 1:23:41]: And honestly, sir, I don't want to see any five foot sidewalks in there because the kids, you can't anybody over the age of twelve can't ride a bike on a five-foot sidewalk. That's the law in Georgia. If you're gonna ride the kids are gonna ride their bike, they need an eight-foot path. Everything needs to be an eight-foot path. Because a five-foot sidewalk simply [1:23:41, 1:24:01]: says you can't ride the bike on it. So when you get it when you walk out of your door, I don't want you to have to get in the car. I want you to be able to get on your bike, get on the eight foot path, traverse the entire community without getting in the car. I think that's why we need to we we don't need anything that's five foot inside there. We should have a minimum limit of eight feet and then [1:24:01, 1:24:21]: Then I think the recommendation was actually good because the work had all been done, had been done from uh up top with Jodoku North and Jodico South. So I don't want to lower those standards. I think we're at a place where you're trying to put together a best in class development. Let's just move forward with doing. [1:24:21, 1:24:36]: doing it in in a precise manner uh and then have it be a completely walkable, transformative community, like I said, where you can walk out of your front door and you can jump on your bike and and walk and ride it from that to point forward. [1:24:37, 1:24:37]: Mr. Blount, please. [1:24:39, 1:24:40]: Um [1:24:42, 1:24:45]: This project has had um [1:24:46, 1:25:06]: I can't count how many meetings um that we've had pertaining to this project. And when we to get to this point, we've talked about the right-of-way and the eastman's and the problems we would have putting in 12 feet. That's why I went to our city manager. I even wanted to find out how why it was [1:25:06, 1:25:12]: uh Reese Creek Trail and it's not even twelve feet wide. It's wrong. Uh and so [1:25:14, 1:25:18]: having the meetings and coming up with this w w what we have now [1:25:19, 1:25:25]: th in talking with staff and and you all, uh, John, is that you showed us [1:25:26, 1:25:28]: that was fiesible [1:25:29, 1:25:33]: In in in the lengths for both sides of different roads, but on the main corridors. [1:25:33, 1:25:53]: And on the frontage roads, what is best because of what's already in the ground and what what and the uses and and what uh with the setbacks and all the the things that are involved with that. So we're at this point, and at this point, I thought that we was ready to go ahead and move forward. We are. And so when we [1:25:53, 1:26:13]: We when if we go ahead and move forward tonight, if there's some amendments, then so be it. But we've had these meetings, and these meetings have got us to this point. And the amendments that are brought forward to us, it's not the first time we've seen them. So we need to go ahead and make whatever needs to happen tonight, make it happen, and we just move forward with what we need to do. [1:26:13, 1:26:14]: [5175.4, 5185.8]: Okay. And then the coun uh council yes ma'am, go right. I do. Um and uh agree with Councilman Blount. We have had several meetings, but we've had s um separate meetings. [1:26:26, 1:26:41]: Um in the discussions that I've had with staff, I still have a concern and hopefully I'm speaking for all the citizens because we've waited so long. We're talking about a lot of the residential here and I want to make sure that the city [1:26:41, 1:26:48]: is have some type of uh agreement or whatever that's gonna come after [1:26:48, 1:27:08]: the the residential versus the commercial. So I want to make sure that we have something in place for that. Because I know a lot of times when you're building, you can end up with all commercial if somebody goes belly up. And I don't want that to happen with us. Because we're saying foot traffic, but we brought in chicken salad chicken. [1:27:08, 1:27:28]: chick and we had a lot of foot traffic. Um you can't get on um Eagles Landing Parkway um with that in combination with Mo's. But my main concern is there's a lot of residential here. And a lot of the citizens have been waiting for commercial, top knot rest restaurants. [1:27:28, 1:27:33]: all of that. So I don't wanna say that this will end up with a lot of residential [1:27:33, 1:27:53]: And then somehow later we'll coming back to the table. And um you're presenting that, you know, there's a halt on this. So I just want to see, Miss Moore, is there something that we're gonna put in place um that will actually protect the city in reference to the timeline from the commercial, I mean from the residential to the [1:27:53, 1:27:53]: The commercial. [1:27:54, 1:28:14]: Um again you have two choices. You have give you some alternatives. Um planning commission and staff was fifty-fifty, which we thought was a trigger. Um but if you want other triggers based on what he's proposing, which is the 70-30, I think what we've talked about is a penalty, a financial penalty that based [1:28:14, 1:28:34]: says that within 12 months, if that commercial development does not occur, a penalty in the form of a a bond, that basically says in 12 months, if that development commercial, if some commercial doesn't occur based on whatever formula you give, then that financial penalty is such that [1:28:34, 1:28:40]: that it would encourage hopefully the owner of that site to come forward with the [1:28:40, 1:28:46]: commercial because they would not want to lose the bond money or whatever that amount would be. [1:28:46, 1:28:54]: Uh, they wouldn't want to lose that to the city because I mean, whether it's a a half a million dollars or a million dollars, I don't think anybody would want to lose that. [1:28:55, 1:28:56]: to a government. [1:28:56, 1:28:59]: For non performance or non ability to start construction. [1:29:00, 1:29:03]: I mean that was something that we tossed around. I I will let the um [1:29:03, 1:29:18]: The applicants speak to that, but other than the fifty fifty uh and having some additional language that deals with a penalty clause, uh and legal may be able to speak to that. I just don't know what else, you know, gets you the assurety that the commercial will one day come. [1:29:19, 1:29:39]: Mayor. If I can do a follow up. Yes, sir. Thank you. Thank you, Mayor. I would like to hear from our legal and also the applicant, um, because we do have our citizens here tonight. Um and I just want to be transparent so they know exactly what's going on, what will take place in our community. I don't want us to just say we're ready. [1:29:39, 1:29:48]: We're ready. I just want to be transparent and speak on, you know, from your end. Stand by one second, please. Ms. Moore. [1:29:48, 1:29:55]: You have a question, sir. Go right ahead, please. I have a question before the applicant speaks. Um because in our meetings the the [1:29:55, 1:29:57]: The understanding when it comes to [1:29:57, 1:30:00]: The residential when it comes to the housing market. [1:30:00, 1:30:04]: And when it comes to any market pertaining to businesses and commercial. [1:30:05, 1:30:09]: We can put something in there, but there's still no guarantee. Right. [1:30:10, 1:30:12]: There's no guarantee on any neither market. [1:30:13, 1:30:22]: And one of the things about it, once you build a commercial piece, this is a mass piece of land, 150, I think fifty eight acres or something like that. There's no guarantee, even if we put the verbiage in there. [1:30:23, 1:30:28]: What you're trying to move forward tonight is this piece and let the citizens know. [1:30:28, 1:30:34]: We can say what we want, how we want it, and how we're gonna do it, but to be transparent. [1:30:35, 1:30:43]: We can give you the power in the sky, but if it don't happen because of the market, then that's because of the market. It's not because of anything the builder done or the city. [1:30:43, 1:30:45]: There's no guarantees in that area. [1:30:45, 1:30:57]: Now to say that when we bring the commercial piece in, will that attract commercial peace? Of course it will. It's been assured to me by our staff and by the it's supposed to. [1:30:58, 1:31:07]: But we can't there's no guarantees. Mayor. And I and I can we hear from the staff and the applicant? I got I wanted Miss Moore to [1:31:07, 1:31:27]: Right. You're absolutely right. And I think what we talked about in the meeting is what could be a compromise between the 50-50 and the 70-third thir 70-30. What about a 60-40? You know, we don't know, you know, if that meets or not, but the applicant can speak to that. Again, our only concern is that we just want to make sure that commercial happens. [1:31:27, 1:31:35]: If you say, you know, based on a certain number of residential units that you put forth a commercial permit. [1:31:35, 1:31:55]: You know, something commercial showed you doing something. I I think that's all we were trying to do. And and if the applicant gives you the comfort level that something is gonna happen, we get it. But from our perspective, we were just trying to hold firm to the vision that we were given that what JodyCo was supposed to be, and so we're just trying to [1:31:55, 1:32:13]: to do that. We're okay with whatever you adopt. You've got a 50-50 staff, you've got a 70-30 applicant, and in the middle could be a 60-40. And okay, Ms. Grant. One second please before you go. Mr. Turney, I know you all you you and the sitting manager are discussing some things. Anything you need to add right now? [1:32:14, 1:32:23]: W we did look at in some detail at various options to try to ensure that the commercial piece comes online. [1:32:24, 1:32:28]: Um but I agree with uh Mayor Pro Tem that [1:32:28, 1:32:39]: There there is no way you can guarantee. We don't know what will happen tomorrow with the market. It could go up, it could boom, we could get all the commercial we get before we get all the resident. We just don't know. [1:32:39, 1:32:42]: Um but what we do know is that [1:32:42, 1:32:51]: um commercial uh investors tend to look for rooftops and concentrations and and and you know the [1:32:51, 1:33:01]: the hope is and and I c all I can speak to is you know the r the staff recommendation was fifty fifty, but the hope is as soon as you get that residential coming online [1:33:01, 1:33:05]: It will make them make it a much easier sell for them to go to. [1:33:06, 1:33:14]: various potential tenants in the town center and say, look, this is coming online. It's gonna be easier for you to come in and make money. [1:33:15, 1:33:20]: Thank you, sir. Mr. Mr Mr Grant. Mr Grant, please sir. [1:33:21, 1:33:40]: Well, Graham said, please. I'm Jeff Grant. Uh uh, we are the applicant here on the property and the owner of the property. And just to give you a little bit of a history, I I think this may make everybody feel a little bit better. We've owned this property since 1985. Dr. Chen and I purchased this uh many years ago, and uh I wished he was here to enjoy this with me. [1:33:41, 1:33:54]: And it this has been a long journey for all of us, especially the city council us together. And and I, you know, I I I I hear the concerns and what I need everybody to understand this whole room, I was raised right here next door to the city hall. [1:33:54, 1:34:11]: I've been a count I've been a stockbridge bar all my life. I just recently moved out of Lake County hoping to retire, but most of our land holdings here in Henry County. I own approximately 4,000 acres in this county, so I'm v very well vested in this county, more so than probably one of the largest landowners in the county. [1:34:11, 1:34:25]: And so my grandfather always told me a man to put his money where his mouse at. So let me just share this with you. We've got to this point six and a half million in this property right now, my own cash, out of my own pocket. There's no debt on this property at all. [1:34:26, 1:34:31]: And so if there's any concerns, it should be my concern. Yeah, all I can tell you folks is this. [1:34:32, 1:34:39]: I'm wanting this to be a legacy for Dr. Chin. He was a dear friend of mine. I loved him dear like a second dad. [1:34:39, 1:34:45]: This property has got more meaning to me than probably any piece I've got in this county right now. [1:34:45, 1:34:52]: I want this to be a successful project. I can't predict, don't have a crystal ball. All I can tell you is this. [1:34:52, 1:34:57]: I'm gonna do the very best I can possibly do out here. I've already turned out enough [1:34:57, 1:35:01]: Um sites up in the front for your fast food places. [1:35:01, 1:35:06]: for your gas stations. And let me tell ya, the prices were very enticing. [1:35:07, 1:35:23]: And and we've turned those down. Everybody thinks I'm crazy for doing just that. But I'm telling you right now, everybody that we're talking to is excited about the project. We've hired a PR firm that wants to come sit down with the city council once we get past this, to sit down where you have a groundbreaking [1:35:23, 1:35:43]: And let me tell you, the people we're talking to, I'm I'm excited because I do want to bring nice restaurants to this site. I don't want to bring all the fast foods that we're typically used to on every site and every corner in Henry County. This is the last major site we have in this county to do something we'd be proud of. If you see what we're already capable of what we're doing and what we're designing, I think [1:35:43, 1:35:48]: go by we have a very comfortable feeling. And so folks, all I can tell you is this. [1:35:48, 1:35:58]: I don't have any debt. I intend it looks like we're gonna put another five and a half to six million more into the project before we even realize the first penny back. [1:35:58, 1:36:06]: All the commercial developers that are coming to us want to see the rooftops. They're worried more about that than we are. [1:36:06, 1:36:19]: And so what I had proposed, the reason we went with A, B, and D, it meets their pod E is the is the city walk area, and Pod F is for the bigger commercial. Then you've got the lots, of course, along Jotoko Road. [1:36:20, 1:36:26]: We we we we bottleneck the residential to those three pods specifically. [1:36:27, 1:36:44]: And what was created in those three pods is what we're trying to hold to. And I think it came out a little less than seventy. I think it was more like sixty, eight and a half, maybe almost two thirds of the residential. But please understand by the time that starts, we're gonna be starting on the commercial at the same time simultaneously. I I would hope. [1:36:44, 1:37:04]: But by when we're doing the residential, we're also gonna be doing commercial at the same time. I'm not just focused on the residential. Let me tell you, I don't get my money back out of it nowhere near it on the residential. It's not even a break-even deal for us. My money's been made on the commercial portion of it. And with the help of the city council and with a marketing firm that we've got in hand right now, [1:37:04, 1:37:09]: I think you guys gonna be proud. I'm putting a lot of money into this thing, a lot of pride into it. [1:37:09, 1:37:29]: And and I stand here before you and I thank each and every one of you because I tell you, we have spent years getting this done to this point. And I want to thank each and every one of y'all. Y'all have been a blessing to work with. Camilla's been great. Um our city attorney and city manager both have been great to work with. When we've called for meetings, you guys have blessed us with them. And and [1:37:29, 1:37:36]: And so we're to this point now that that this is just something that I've got a passion for. [1:37:36, 1:37:41]: And I can promise as I'm standing here right now, this will be this is gonna be a good project. [1:37:41, 1:37:46]: I I'm not gonna incur any debt on it, don't intend to through this whole project. [1:37:47, 1:37:59]: The market goes down, we'll wait it out until but we're gonna build something when it does come back it'll be done right. I'm not gonna put anything in that shabby. This development agreement, I think if a man's got anything in this thing, if you look at the development agreement, we formed here. [1:37:59, 1:38:02]: It's very intrusive and it's very detailed. [1:38:03, 1:38:16]: And so we th this thing has been so well thought of and thought out. Uh I'm proud to be part of it. And so if there's anything I can give you of any of any any hopes, um of any guarantees [1:38:16, 1:38:17]: I've got my money in it. [1:38:18, 1:38:24]: Ain't a better guarantee that you can do than put your own money and put my own billfold out there. I haven't asked for a penny from anybody. [1:38:25, 1:38:27]: From the city, from the county, anywhere at all. [1:38:27, 1:38:30]: It's my money I put into it, our property. [1:38:30, 1:38:34]: And and I I'm I if you'll work with me, we're almost there. [1:38:35, 1:38:37]: I promise you you'll be proud of this project. [1:38:38, 1:38:58]: That's all I got to say. Thank you, Mr. Grant. Any any specific question for him before we go to open something already, please. All right, Mr. Grant, I appreciate that. Have you acquired the Chevron property over there already? Have you already acquired that? Are you? It's it's actually under contract. We're getting ready to close that. I think um um Mark has got that ready for us to close. [1:38:58, 1:39:00]: close I look to close it probably the next week. [1:39:01, 1:39:21]: Within the next week. Yes, and and and we we got to talking about these past. We actually excuse me, friend, but we're actually waiting to get this done before we can close that piece. Okay, so so we we were actually talking about the past and all in and all before. I think you uh as a conservationist and the person that you are in terms of everything that you do [1:39:21, 1:39:41]: Do you want to build this best in class development as we do? Um I just want to make sure that everybody understands we can build this with the 12-foot pass, right? We can build this with the eight-foot sidewalks. Let me tell you the 12-foot, the problem you've got on the state, on the portion coming through. I think what the state in reading their [1:39:41, 1:40:01]: concerns on a 12 foot path on a major thoroughfare. Not the major not the major thoroughfare. I'm okay with the 10 foot deck. Well you get to the city walk here um uh Mr. Alexander it's it's that it's actually even more than that. I think it's actually more when you get to the City Walk the connectivity that we've got on the all the different roads keep in mind there are eight foot sidewalks if I'm not mistaken eight foot on both sides. [1:40:01, 1:40:03]: sides now, not just on one side, but on both sides. [1:40:04, 1:40:24]: The connectivity paths between each one of these are at least that wide. Now the major road coming through, it was a 10-foot path. We had actually asked the state about 12. They're the ones that denied that because they're saying once you get over that 10-foot path, people have descendants who want to jump the curb and drive along it if traffic gets bad, which becomes a dangerous element within the community there. [1:40:24, 1:40:31]: And so it and it made sense to us. But a 10 foot path coming through that one, that's a big path now. It's a lot bigger than you think it is. [1:40:32, 1:40:37]: Don't let don't let two foot what you talking about space that wide, don't let two foot [1:40:38, 1:40:58]: Kill a four hundred million dollar project here. Well we we definitely don't want to do that. We want to make sure that we build it in a in a in a in a better very five foot sidewalks. Do we have a we don't wanna have five can we make sure that the interior neighborhoods have I don't think we have five foot anyway. [1:40:58, 1:41:18]: If I'm not mistaken. They're going down to eight. Yeah. Eight. Okay, well that's that was my contention. I didn't want the five. So I'm okay with the eight if they're going through the neighborhood and not not down the four. That's not a single sidewalk in the disbelieving that's five feet. Okay. All right. Well nothing. Okay. We missed the vote. [1:41:18, 1:41:32]: Ms. Robinson, please. Yes. Thank you for explaining it, knowing that we have our residents here to know that you're from here and you're investing back into this community on the land that you owned. That you own. So um [1:41:32, 1:41:52]: A lot of my questions came from a lot of the citizens, so it was clear tonight. So I thank you for being clear um and letting everyone know where you're trying to go um and how this development is gonna really um increase the value here in our community. So I just want to thank you for definitely choosing to give back and be a part [1:41:52, 1:41:57]: Yes ma'am. Thank you. [1:41:57, 1:42:17]: I just wanted to be clear. The sidewalks are no less than eight feet in inside, correct? And then ten on the major we're good. Okay, we're we're great. Thank you. Thank you for uh being patient with us. Yeah. M Mr Thomas. No no I I'm I'm good. Um I think the do due diligence has been made. [1:42:17, 1:42:25]: Um I just think it's time to move forward. What what's this now? This is what he's proposed. [1:42:26, 1:42:30]: I just wanna make sure'cause I I we wanna make sure about the sidewalk situation. [1:42:30, 1:42:35]: We're talking about subdivision sidewalks, right? Eight feet. Eight feet. Eight feet. [1:42:35, 1:42:43]: Is that what you all division sidewalks are eight feet? Are you all are you all comfortable with that? We did it six feet four in front of your seventh in front of your house. [1:42:44, 1:43:04]: I don't remember eight feet in front of all the roads. Oh along your roads is eight and ten in front of pod A and C. Because those are your only two pods. You talk to your single family Dcash because everything else is a cluster. Along your A and your C are [1:43:04, 1:43:10]: Your map in front of your house, the standard is four. We went to six. [1:43:11, 1:43:24]: Yeah. That's only on the single family. Yes on your single family standards in your codes is four feet. Can I ride a bike on it? On a six foot side? Yes. Okay. I just wanna make sure. And on the five foot you can't. [1:43:35, 1:43:47]: Okay, and I got one more. You got one last comment? Yes, sir. While you up there, Mr. Grant, everybody waiting with bad breath. Give us something. Give us something good. Encourage us that we just got [1:43:47, 1:44:07]: Uh l all I can tell you is is is we are talking to different ones, um to different restaurants that we don't have in this county that are very unique. I think um uh uh I I think you'll see here in in the very short period, uh once this has passed, our our uh marketing group uh [1:44:07, 1:44:27]: We is planning on getting with you. We've also got a the market group, but we also have a um a commercial developing group that's all they do is is deal with commercial problems. They're also gonna be sitting and talking to you and giving you uh options that we'd like to see that we're gonna present before the city council before we make it public. Uh because I hate to make something public. [1:44:27, 1:44:33]: That you don't like, then all of a sudden we have a disagreement here. But but but please understand that [1:44:34, 1:44:36]: Living here all my life. [1:44:37, 1:44:57]: Um we have set aside in this county as we as I stand here today, we have set aside almost two thousand acres in this county throughout the county and perpetual green space that won't ever be developed that already had zonings for a lot of smaller houses. I think we have um eliminated almost eleven thousand small houses. [1:44:57, 1:45:10]: that won't ever be built, that that the conditions that were given back years ago were something we wouldn't want in this county right now. And so please bear that in mind. That's how civic minded I am. [1:45:10, 1:45:14]: That we set that aside in perpetual green space and that's under federal protective program. [1:45:15, 1:45:17]: Okay. Thank you. On that note [1:45:17, 1:45:19]: I'd like to open up the public hearing. Thank you, sir. [1:45:20, 1:45:20]: Excuse me. [1:45:21, 1:45:32]: o okay, I'm sorry. I'd like to open the public hearing. So for this particular project, if you want any comments, if far my far left and over here, any com particular comments if you want to do it for [1:45:33, 1:45:34]: In the middle, four. [1:45:36, 1:45:38]: My far right four. [1:45:39, 1:45:40]: Against this project. [1:45:41, 1:45:42]: Comments on the far left. [1:45:43, 1:45:44]: Middle. [1:45:45, 1:46:03]: Far right. Seeing no comments, I close the public hearing. Okay. So so Mayor, um board council would adopt before you tonight is the recommendations as approved with an amendment if you so choose for these two sections and you have a copy in front of you. All right. [1:46:04, 1:46:10]: So council, you have the copy in front of you for that amendment. I need a motion to approve the design guidelines, please. [1:46:11, 1:46:14]: So moved and seconded. Okay, any further discussion? [1:46:15, 1:46:16]: All in favor, please indicate. [1:46:17, 1:46:31]: Okay, wait. Are you approving it with what? With the with the with it with or with the I I thought it was with the amendments. Okay. I thought it was with she says so moved. You mentioned the m I thought it was with the amendments. He says she you mentioned the totality of the amendment. You didn't do a either or, you said with the amendment. [1:46:32, 1:46:43]: Right, in other words, um a motion can be made to accept staff's design standards with an amendment which has been given to you by the developer. [1:46:44, 1:47:04]: Or a motion could be made to a sta adopt staff standards without the amendment. Okay. So it's either with the amendments or without the amendment. I assume this is with the amendments but go ahead. So I s I I I'll let me let me redo that. I motion to accept. [1:47:04, 1:47:24]: The amendments which has been agreed upon that has been given by staff for this project. Okay. Motion made. Second. Second. Now, any further discussion? Yes. Go right in. I'm going to abstain from this vote. And the reason that I'm going to abstain from this vote is folks have been seeing me out front talking about this project for years. Folks think [1:47:24, 1:47:42]: think that I have some type of investment in it, but I don't. I don't I'm just trying to be promoting the community to make sure that the project moves forward. So so folks don't think it anything of it. I don't have any energy, any financial uh gain from the project, I'm gonna abstain from vote. All in favor of the motion, please indicate. [1:47:43, 1:47:46]: Fantastic. All right. About time. [1:47:47, 1:47:47]: All right. [1:47:48, 1:47:49]: That's [1:47:50, 1:47:52]: Moving forward, folks are moving forward. All right. [1:47:53, 1:47:54]: I'm happy about that. I'm sorry. [1:47:56, 1:47:58]: I can sleep good tonight. [1:47:59, 1:48:01]: We are now going to go to um [1:48:01, 1:48:03]: Public hearing amendment number seven, amendment. [1:48:04, 1:48:05]: Of uh chapter [1:48:06, 1:48:08]: twelve point zero two point one oh four. [1:48:08, 1:48:11]: Highway overlaid district to amend the boundaries [1:48:11, 1:48:15]: To include the following Patrick Henry Parkway, Country Club Drive. [1:48:16, 1:48:36]: Flippin' Road, Walt Stevens, Mount Zion Parkway, and Campground Road Extension. Presented by Miss Moore, please. Yes, again, uh when the county uh went forward with their overlay district to include major thoroughfares, uh we followed suit. Uh we went back and however discovered that we actually left out these major roads. And so we [1:48:36, 1:48:56]: What we're asking Mayor and Council to do tonight is to amend your ordinance that lists our streets to include these streets that are listed here so that as applications come through on Patrick Henry, Walt Stevens, Mountain Zion, any of those roads that the guidelines as it established that requires a certain percentage of brickstone and stucco. [1:48:55, 1:49:01]: Uh and the landscaping and all that also applies to any developments that come along these roads. [1:49:01, 1:49:21]: Okay, any questions, Council for Miss Moore, about this? No questions. I get one. Go right in, please. Now I'm I hate to be beating a dead horse. Is this appropriate to at this point to add the requirement for the charging stations and all of that to this? Is is is that possible? As a requirement for new development or substantial development. [1:49:21, 1:49:23]: in there along the overlay. [1:49:24, 1:49:29]: Uh it's already in there. In your other overlay district we require those things. We just didn't have these robes in there. [1:49:29, 1:49:44]: Okay, you had the s charging stations in there too? Oh no, no, no. You want to add the charging station. No, this would not be um that would go in another part of the ordinance. Mm-hmm. This is just include those roles. Um, well I guess you could amend it. We deal with the standards that are in there. [1:49:46, 1:50:00]: Separate. Yeah. Legally saying we should do that separately. So just add these ropes and then come back and amend it to deal with charging stations. Do we have to do a um do we have to do a public hearing for this one or not? No. It's a it's a public hearing. It's a board instruction. Thank you. [1:50:01, 1:50:07]: That's it. Okay, any other comments? No other comments? All right. So for the public hearing [1:50:07, 1:50:09]: I'll open this up and uh [1:50:10, 1:50:20]: Anybody for or that has agreement before this particular amendment to add these additional uh streets to the highway overlay district on my far left. Any comments at all? [1:50:21, 1:50:22]: In the middle. [1:50:23, 1:50:25]: Seeing none, far right. [1:50:25, 1:50:30]: Okay, seeing none. Anybody against they want to make comment on this? Far left. [1:50:31, 1:50:32]: Middle. [1:50:33, 1:50:43]: All right. Uh seeing none, hearing none, so I'll close the public hearing. All right. Council I need a motion to adopt uh the amendment to charter [1:50:43, 1:50:45]: twelve point zero two [1:50:45, 1:50:47]: That point one oh four. So move. [1:50:47, 1:50:49]: Is there a second? A second. [1:50:49, 1:50:50]: In for the discussion. [1:50:50, 1:50:52]: I'll favor you please indicate. [1:50:52, 1:50:53]: Outstanding. Okay. [1:50:57, 1:50:57]: Public hearing. [1:50:59, 1:51:19]: Council consideration to approve rezoning of case RZ 2019-04 rezoning request by TPA residential requesting the rezoning of the property from C2 General Commercial District to Mixed Use Neighborhood Residential District for the purpose of constructing [1:51:19, 1:51:39]: and mixed use development projects with townhomes and commercial uses usage. Property is identified by parcel ID zero three two dash zero one zero two six zero zero zero and is located to the rear of fifteen eighty and fifteen ninety Hudson Bridge Road and to the west of fourteen ninety [1:51:39, 1:51:59]: to fifteen forty eight Hudson Bridge Road. Property consists of twenty point six, excuse me, twenty point three six seven acres within land lot twenty-one of District Six in the city of Stockbridge. Miss Moore, please. Yes, uh I think the uh let me just start off by saying is that we had requested a letter from the state ARC regarding [1:51:59, 1:52:13]: regarding what this property could be developed for. They did not have this ready tonight. Uh we weren't able to contact the applicant in terms of being here because we did not have the letter. So I'm not sure that he's here tonight, but we're gonna go ahead and proceed [1:52:13, 1:52:16]: Uh with the public hearing. That's okay. [1:52:17, 1:52:27]: Alright, so mixed use developments. We just went through Jodico. They can be quite challenging. Uh, which brings us to the subject site. Uh, this subject site. [1:52:28, 1:52:29]: Iničali [1:52:35, 1:52:40]: Uh I'm sorry. Let me go to the side close tab. Uh [1:52:43, 1:52:45]: Let's see if I can find it. [1:52:46, 1:53:00]: It may not have come up. This subject site was a part of a master Miss Moore. It's like the third one down, I believe. Okay. Let me see. I might so let me go to this page. If everybody can see this. [1:53:01, 1:53:07]: So mixed use development, uh typically when they come in, just like Jonathan, somebody owns all of this land. [1:53:07, 1:53:10]: And they want to do commercial and residential. [1:53:10, 1:53:16]: Uh this parcel 70 point six one acres was originally located in the county. [1:53:17, 1:53:18]: And [1:53:18, 1:53:36]: The city of Stockbridge annexed it in 2002. A DRI was done on the whole 70.61 acres. And kind of like what we talked about with the other project, how do you ensure that the project comes online together? [1:53:36, 1:53:42]: In this particular case, the Walmart property developed. [1:53:42, 1:53:44]: Came online. [1:53:44, 1:54:04]: And it has developed and it's changed, it's had a couple of iterations. As you see in the initially when it was platted, this particular parcel actually had access to Hudson Bridge Road. But when they came back and developed the Walmart Plaza, they took away the frontage on this particular property. [1:54:04, 1:54:11]: And the DRI required them to create internal streets. Let's see if this works. Does it work? [1:54:13, 1:54:33]: Okay, all right. So here's the tr the Walmart track right here. Here's the track in question right here. All of this was the master plan, which was Walmart Center Station. That's what it was called. Initially, this parcel actually had access to Hudson Bridge Road. However, when they came back and decided to develop [1:54:33, 1:54:53]: The Walmart Plaza, they took away the frontage. The DRI required them to do internal streets, and then all the out parcels out there that you see with Taco Bell actually came in. So what you have before you tonight is the remaining parcel of the master use. Initially, in this master. [1:54:53, 1:55:06]: master complex, 1,500 apartments were supposed to be developed on this 22-acre track. And what the state required was that a minimum of 200 apartment units of the 1500 come online. [1:55:07, 1:55:27]: It's been ten years, right? So it's been sitting there. So what is before you tonight from a planning perspective is what staff has brought to you only the portion here that is the remainder of the seventy point six one acre tract which was designated in the DRI for multifamily to [1:55:27, 1:55:28]: Uh develop that. [1:55:29, 1:55:49]: The applicant is asking that instead of the 1,500 apartment units that was only mentioned in the DRI, that instead they were looking at doing 138 units. However, based on the topography, they're not able to do the 138 single-family units. [1:55:48, 1:55:50]: [6950.6, 6956.2]: These are not apartments, they are single family attached homes. [1:55:56, 1:56:02]: They pay taxes to the county, they pay taxes to the school board. [1:56:02, 1:56:15]: So planning and the planning commission and staff, we only did a planning analysis, that's all, based on the master plan and based on our current land use. So why is this before you tonight? [1:56:16, 1:56:36]: We just went through a land use process where we were trying to get rid of all of the old planning conditions in which you segregated your uses. So instead of having commercial here, office here, residential here, to create more of a mixed-use classification. [1:56:35, 1:56:41]: education, understanding that in any of your mixed uses, you can have single family. [1:56:42, 1:56:54]: provided they're consistent with your density. So what does your land use map requires for the 22 acres? It requires a density of six units per acre. [1:56:54, 1:56:58]: The applicant initially asked to come in at six point eight. [1:56:59, 1:57:11]: But based on the topography and based on how we platted, he cannot get the 6.8. He can only get the six acres per unit as outlined in the comprehensive land use plan. [1:57:12, 1:57:14]: So what surrounds the site? [1:57:15, 1:57:16]: Did I lose my little marker? [1:57:17, 1:57:19]: We find okay, so [1:57:19, 1:57:22]: Over here we have Oakwood Subdivision, single family. [1:57:23, 1:57:28]: Here we have Saint Anne's apartment and Saint Margaret's. Am I pronouncing that correctly? Margaret's? [1:57:29, 1:57:32]: is the subdivision. So you have apartments here [1:57:32, 1:57:52]: Um single family here and then you have single family here and then you have all of this commercial. I really do think back when the the city probably and next this we probably should have done something very similar because this is a reverse. The basis say we needed a trigger. We should have had all of this developed at one time. [1:57:52, 1:58:12]: But that is not what happened, but this is what we actually have today. So, based from a land use perspective, it is consistent in the sense that they can only do six units per acre. Based on a transition of use from heavy commercial all the way to your residential, planning says that you're supposed to have a less intense use, and I don't think [1:58:12, 1:58:23]: anybody wanted the 1500 apartments. They're originally a part of the DRI. So for us, anything less than 1500 and the fact that they were single family from a planning perspective was okay. [1:58:23, 1:58:43]: Um, so we felt it was consistent with our plan and with the master plan. Even though the master plan called for apartments here, we don't think that apartments would have been suitable simply because as many council people have pointed out, there's a traffic issue down here on this internal street. [1:58:43, 1:59:03]: So when they took away the frontage, they created an internal street, but the concern is how will those 128 units, you know, how it has two car garages, what would be the traffic impact with them coming out on this internal street, going to the light here or going back up by Bank of America? And those are very [1:59:03, 1:59:05]: Legitimate questions. [1:59:05, 1:59:25]: Uh and the DRI for some reason thought they addressed them. So the DRI they do do projections. What they don't handle is properties that come on this side and commercial properties that come on this side, because nobody knows. If they're not large enough for the state to come in and do a DRI, you're not gonna have it. So since this was [1:59:25, 1:59:45]: Platted way back then, a whole lot of traffic has occurred on Hudson Bridge Road. Now it's my understanding that Hudson Bridge is going to be widened. They're going to do some additional lane improvements. Don't know where they are, but we will get that. Now we have requested from the state some clarification on this property. [1:59:45, 1:59:52]: If we have exceeded the three hundred and forty-two thousand square footage that was um [1:59:53, 2:00:13]: given for the Walmart, then that means that no more commercial can come in this area. So we don't know the fate of this. We're just asking the state, if it's important to Marion Council, it may not be, to make a decision on what is this property good for. Uh we know we don't want apartments back there because it definitely couldn't handle 1500 units of apartments. [2:00:13, 2:00:30]: So what is it good for from the state perspective going forward in the future with this 22 acres, what what can it be used for to be given some indication in terms of what this is? And that's just a basic planning perspective. All right. [2:00:30, 2:00:34]: On that note, uh council, any questions for Miss Moore? Additional questions? No. [2:00:36, 2:00:41]: All right. If not, this is once again a public hearing. So I'll open up the public hearing. [2:00:42, 2:00:45]: And um I start a course on my left hand side. [2:00:45, 2:00:51]: Um so on anybody for in this section for this particular mixed use development. Anybody for? [2:00:52, 2:00:53]: In the middle anybody four. [2:00:54, 2:00:55]: Four. [2:00:55, 2:00:56]: Come on, sir. [2:00:58, 2:01:00]: Please identify yourself. [2:01:01, 2:01:21]: Again, my name is John Palmer. Um good to see you again. Uh the applicant, we are uh their engineer, but we're not the applicant. Uh they had requested the property be tabled, uh the project, and their understanding was that it was tabled. So they are actually not here uh tonight to answer any questions or speak to it and [2:01:21, 2:01:32]: They've told me to again request the tabling of this project. So they can get more information from Greta uh on the DRI and address some community concerns. Thank you. [2:01:32, 2:01:33]: Okay, thank you. [2:01:35, 2:01:44]: Yeah, so okay. Uh anybody else for? Uh on this side. Anybody against? On this side, far left. Anybody against? [2:01:45, 2:01:50]: The middle against anybody up on this end against. Against. Come on up, please, sir. [2:01:53, 2:02:13]: Good evening. I'm my name's Tim Callahan. I work I live at uh 146 Oakwood Circle, directly beside this property. Okay. I'm speaking against it, uh not entirely as it shouldn't happen, or something to that effect. It's more to the idea that uh the considerations to date have not included certain elements. And I ask that you consider those things. [2:02:13, 2:02:13]: Right. [2:02:15, 2:02:22]: Particular things of concern to me are the fact that the quality of life which the city has fought over for last two years. I [2:02:22, 2:02:24]: To ensure that uh things are good. [2:02:25, 2:02:28]: are impacted heavily by the schools and the school quality. [2:02:29, 2:02:35]: And according to the school board, this would require eleven classrooms or three point three million dollar investment. It paid create elementary by itself. [2:02:37, 2:02:42]: Now we all know that tends to be that schools being overloaded tends to bring their quality down. [2:02:42, 2:02:45]: And we know that trailers in as opposed to [2:02:46, 2:02:51]: Classrooms, which would have to go into place if this was built and occupied, uh are also not conducive to learning. [2:02:52, 2:03:12]: I also have a question as to whether or not the uh roadway that is proposed for the two exits uh indicated uh are currently pre you know the city's currently prepared to ma ensure the maintenance of those. As they're outside of the property, it would fall to the city to maintain those. And with 138 new homes and traffic uh [2:03:12, 2:03:18]: It would be interesting to try and exit by QT, uh considering all times of day and night. [2:03:18, 2:03:20]: It is rather dangerous to execute T. [2:03:21, 2:03:22]: At that point. [2:03:23, 2:03:43]: Now I do want to also ask that you consider the fact that yes, this was originally zoned or considered uh in 2002. Uh it was a different, definitely a very different council at that time. And different plan, different attitude of the community at that time. And at the time it was zoned, it would have the uh requirement of uh having this branch of [2:03:43, 2:03:52]: residential properties at a density that is for all extraordinarily high. The density proposed it's still high. [2:03:53, 2:04:13]: 138 homes, 100, you know, that many kids, and that much traffic coming through a very narrow corridor is going to be problematic for emergency services, it's gonna be problematic for the schools. So I do request that when you do consider this, uh that you consider a lower density than what the maximum [2:04:12, 2:04:21]: Maximum required by zoning code is so that it accommodates the fact that the schools in the area can mitigate the impact. [2:04:22, 2:04:25]: I also want to point out that while [2:04:26, 2:04:46]: The assistant uh city manager stated at the zoning meeting that the zoning committee is not required, I apologize, is not required to uh consider the schooling or the school board's comments uh as part of their consideration for approving the zoning. I think it would be extraordinary. [2:04:46, 2:04:54]: Ordinary disservice not to consider the schooling and the school impacts whenever considering any zoning, whether it's Johtaco Project or this one in general. [2:04:54, 2:04:55]: Appreciate your time. [2:04:56, 2:04:59]: Thank you. Anybody else from the section uh against? [2:05:00, 2:05:14]: Okay, on that note I'm gonna close the public hearing. But what I need to ask the council though is since the applicant is not here and supposedly asked for this to be tabled, I guess the question would be to the council whether or not we honor that [2:05:14, 2:05:18]: a tabling request or we continue on with voting on this issue. [2:05:19, 2:05:25]: Okay. I uh you have something to add, ma'am. Well, I just wanted to add before you vote, um I think his concerns about the um [2:05:27, 2:05:35]: The overcrowding of the schools is great, and I think that's why the Planning Commission, some of the residents were happy that these were not apartments, that they were taxpayers. [2:05:36, 2:05:49]: People have said, well, what are we gonna do about Jodico? I I I I think somehow the Board of Education is gonna have to address overcrowding the schools, but for Mayor and Council, that mainly means that [2:05:50, 2:05:56]: Everything that comes in before us, you're gonna have to tell us whether or not you want us to just shut it down. [2:05:57, 2:06:08]: Because it is, I mean, the developments that we have on the table now are going to impact schools because most of those coming in are coming in at mixed use and they do have some residential. [2:06:08, 2:06:28]: And I would be great if all of the cities, Locust Grove, McDonough, the county in particular, and others would get a handle on it, because every city that brings in some development is going to impact the schools. And if y'all want to give us a certain direction to basically say no more residential development in Stockbridge. [2:06:28, 2:06:29]: Yeah. [2:06:29, 2:06:33]: We can do that if you think the school situation. [2:06:34, 2:06:40]: Is overcrowding is being contributed by Stockbridge. [2:06:40, 2:06:44]: Member for Tim Blount, go ahead, please. [2:06:45, 2:06:46]: Ms. Moore. [2:06:47, 2:07:07]: Whatever decision is made up here does not dictate finality for whatever you're saying. Uh if we say we don't want to widen roads, that don't mean we don't want to see cars come down and so to say we stop or whatever we do. W one of the things about we we have to look at each project individually. [2:07:07, 2:07:13]: And and when we look at these projects and this one in particular, we have to look at what we're trying to approve. [2:07:14, 2:07:34]: Um you may have the school element. I live in the area. I'm I'm down that street every day. Uh this when I looked at the DRI paperwork, this came through, I think I saw one that said 2003. So you're looking at over 15 years old DRI that in many areas has already gone out the boundaries that was already stated and and and and defined for [2:07:34, 2:07:54]: that DRI. And so what we're dealing with now is a foundation of something that we can just throw the DRI out the window. Well the state won't allow you to do that. No no no no what I'm saying I'm talking about throw out the window in terms of what is required. The requirements are gone. Right. And when we and when excuse me [2:07:54, 2:08:05]: When we had our meeting with you and our city attorney and our city manager, only thing that we was told, is that I was told is the only thing that we needed was a letter. [2:08:05, 2:08:12]: Everything else was all right and fine, everything was in place. Only thing that was left was a letter. We don't have that. [2:08:13, 2:08:25]: But we was told. So if an okay was given, then only thing that was left was a letter. Then that was no reason to halt this. It's just to say, Hey, what you told me, just send me a letter. [2:08:26, 2:08:31]: Well again, I reached out and followed the instructions to get clarity from Greta. [2:08:32, 2:08:35]: On this site. That is what council advised me to do. [2:08:35, 2:08:36]: I did that. [2:08:36, 2:08:40]: And in talking with Greta, what they've asked me to do. [2:08:40, 2:08:42]: is to send them the file. [2:08:42, 2:08:44]: And they will do a review. [2:08:44, 2:08:51]: Based on that rezoning, based on any potential road widening or improvements, then they would get us a letter. [2:08:52, 2:08:59]: based on their review in terms of an update of that DRI. That's what I was told Thursday morning. [2:08:59, 2:09:19]: Sorry. Ms. Alexander, go ahead and please. Yeah, th this is I've been I I started out my public service career on the zoning board. And Mr. Williams, I need to direct this question to you. And I think it would be very helpful for you to chime in. You know, during all the zoning classes and presentations with the county attorney. [2:09:19, 2:09:39]: He consistently said the law has been very consistent in that it is not a burden upon the developer to establish or to uh to have the school board's responsibility to increase the size of the schools. [2:09:39, 2:09:57]: and to uh plan that growth, as well as the interpretation of the road projects. It was incumbent upon the elected officials to approve the traffic situation, and it was incumbent upon the school board. Folks should understand the school board does have a plan. [2:09:58, 2:10:03]: They're they're very tight lipped about it and they have a three hundred and fifty million dollar budget. [2:10:04, 2:10:20]: They are a total separate entity from us. Yet when you go to their meetings, there might be one person there, there might be two. They have a three, the county budget is$160 million. Our budget is$10 million. [2:10:21, 2:10:30]: The school board has a three hundred and fifty million dollar splot. So they have almost a billion dollars that they manage. We can't touch it. [2:10:31, 2:10:43]: They have all of the money. When you look at your tax bill, they get forty percent. So matter everybody complains and shows up at the county commission meeting about what the taxes go, but all the taxes are going to the school system. [2:10:44, 2:10:58]: But I I would like for you to speak to that in that it is a comment upon us to fix the traffic issues and the school board to fix the the school system. That's their job and the courts have ruled consistently that it wasn't the burden of the developer. [2:10:59, 2:11:10]: M Ms. Alexander, the um engineering firm for the applicant just talked to the applicant and because they don't have clarification from the state, they just want to withdraw the application altogether. [2:11:12, 2:11:14]: Okay, so [2:11:14, 2:11:26]: I mean in that aspect which is a public started a public hearing that closed it. We haven't comments. Legally, where does it stand here, sir? If if they've withdrawn it, there's nothing there's there's no application for you all to act on. [2:11:28, 2:11:46]: Okay. It's it's dead. Is that the weird well one second please? So otherwise they just they got this message, so it we're supposed to honor that. I know some of the podiums. Can you come back to the podiums? Okay, just withdraw on their application. All right. [2:11:47, 2:11:48]: Go ahead, sir. [2:11:50, 2:11:50]: When [2:11:52, 2:11:56]: When uh when John when you when John came up here [2:11:56, 2:12:08]: He said that the applicant uh w no no no no when you came up here, he said that the applicant would like for us to basically hold off on it until we get this letter. [2:12:10, 2:12:14]: Now this saying that the applicant wants to withdraw it. Where did that come from? [2:12:15, 2:12:18]: I don't know. He just told me that. [2:12:19, 2:12:31]: In his opinion, there's no letter from the state, so they would just withdraw. So No no no. What I'm saying is that wasn't in his statement. But to now say the applicant wants to withdraw [2:12:31, 2:12:33]: I think he texts him. [2:12:36, 2:12:37]: Mr. Thomason. [2:12:37, 2:12:53]: I I'm following the same trend of thought of uh Mayor Protein Blount. Um Mr. Palm, I know you represent uh the developer, but I I try to deal with policy, procedure, and protocol. [2:12:54, 2:12:57]: We have nothing here. I'm not saying that you're [2:12:57, 2:13:11]: twisting whatever you're saying. Um but from my standpoint, you know, I I need to I need to have some kind of confirmation with that. So uh I'm saying to my councilmates that um [2:13:12, 2:13:15]: I just have to go forward with this. Um [2:13:16, 2:13:21]: I spoke with staff earlier today and I I expressed some of my concern with [2:13:21, 2:13:38]: the whole process, the whole protocol and the whole procedure. And this is what I try to operate on every day. And and I just don't see this being followed here today. So I'm really having some problem with this whole process of, you know, [2:13:39, 2:13:41]: Today you're saying this [2:13:41, 2:13:45]: Then yesterday you said this and now you're saying this. [2:13:46, 2:13:53]: It's just something that right here. Um, and and I'm a little concerned about this. But I'm just gonna say to my councilmate, [2:13:54, 2:13:57]: You know, this has been published. [2:13:58, 2:13:59]: It's been advertised. [2:13:59, 2:14:03]: It's on the agenda and I spoke this to staff earlier today. [2:14:04, 2:14:05]: That [2:14:05, 2:14:07]: All of this was [2:14:07, 2:14:09]: should have been [2:14:10, 2:14:14]: straighten and correct it before it even came to the agenda. [2:14:15, 2:14:18]: These kind of development doesn't happen lightly. [2:14:19, 2:14:21]: As mister Grant mentioned earlier, [2:14:22, 2:14:24]: There are millions of dollars in these development. [2:14:25, 2:14:30]: So no one is taking this lightly, and when things begin to move forward [2:14:30, 2:14:38]: It doesn't move forward lightly. So if these uh I's are not dotted and these T's are not crossed. [2:14:39, 2:14:41]: I'm not buying it. [2:14:42, 2:15:02]: I'm not buying it. I missed Boss. This is what I want to do. I want to call Mr. I want to call the gentleman back to the podium so we're not talking over the pole. We're not talking back and forth. And I think what we really need to do is the applicant initially asked us to table it. We should go ahead and table it so we can entertain more discussions to be [2:15:02, 2:15:14]: able to see if we can rectify this situation. So I'm recommending that we table the issue and I would uh make a motion that we table this issue as was requested by the applicant. [2:15:15, 2:15:35]: First of all, is uh first of all, is that a legal motion? If so, is it a second? And I just need a legal opinion from you, sir. I mean, if if what he said is correct, it's already been withdrawn. So there's not nothing for you to act on. Right. Well that's that's what I was gonna say. I mean you w I mean you withdraw the by sending'em a text. [2:15:35, 2:15:55]: message. I believe I believe the gentleman you got a text message without a doubt, but that's a legal way to do something. I mean I'm just well I mean they can announce at the at the actual hearing that they're withdrawing it. So we need to come back to the podium. And initially we we not no no you miss more initially we we you said that they would receive some type of message indicating that they wanted to [2:15:55, 2:16:15]: Hold off on this because they needed more information before we can get started tonight. Okay, I take full responsibility. No, no, no let me explain what happened. Okay. When legal advised me that we needed something in writing from the state, okay. I at that point in time contacted the state. Okay. They were the one who said they weren't gonna have any. [2:16:15, 2:16:23]: Anything available in writing by today. Okay. And they gave me instructions on what I needed to get to them. [2:16:23, 2:16:34]: With that being said, I reached out to the applicant and expressed the concerns that the legal expressed to me that and this was Wednesday and Thursday of last week. [2:16:34, 2:16:49]: That there were some concerns about the DRI and whether or not we were in compliance with this development based on what happened with the Walmart deal, and that we needed clarification in writing so that Mayor Council would have something to consider. [2:16:50, 2:17:08]: When they advised me that they couldn't have anything by tonight, I was the one who called the applicant and said, we need this DRI clarification based on the instruction that legal has given me. And because of that, are you willing to withdraw or defer your application until we get that clarification? [2:17:09, 2:17:17]: That's just normal planning procedure. Yeah, if I could just expand on on the reason we need [2:17:18, 2:17:23]: And this applies whether this project is still on the table or any other project. [2:17:24, 2:17:28]: When the DRI was approved in two тазен four. [2:17:28, 2:17:34]: It had a set of requirements and and under one of the the most important requirements was that it was a maximum [2:17:35, 2:17:38]: Of three hundred and forty three thousand five hundred square fit. [2:17:39, 2:17:42]: Of commercial space, that's the maximum that you could have. [2:17:43, 2:17:47]: Енсо, гивен вот газ аррейбен пунс. [2:17:47, 2:17:52]: And the fact that the original plan had in additional two [2:17:52, 2:17:53]: Commercial [2:17:53, 2:18:05]: pieces on the front right across from where the Taco Bell is, we needed to confirm whether we were even in compliance. We're required as as a local government [2:18:05, 2:18:15]: to cooperate with the Department of Community Affairs and the implementation of of DRI re recommendations and to, you know, stay on top of those. And I'm concerned that [2:18:16, 2:18:20]: even as it currently stands, we're out of compliance. And so it was recommended we need to check [2:18:21, 2:18:23]: And a verbal isn't enough. We need to just make sure [2:18:24, 2:18:28]: Whether it's for this project for any other project, what can happen there? [2:18:28, 2:18:36]: Ms. Gand, go right here, please. Thank you. Um I one, I accept their withdrawal. Um and I n I understand the reasons behind that. [2:18:36, 2:18:38]: Basically if you withdraw [2:18:38, 2:18:58]: You don't have to you can come back, whereas if it was voted down, you would have to wait a year. So I accept the withdrawal at this point in time. I also am concerned, isn't this property now zone commercial? Yes. Right now. And the way they would be coming out is through a commercial thoroughfare between QT and Thailand. [2:18:58, 2:19:18]: Taco Bell in a package store, is that not correct? Right now, right? That would be the road they would be coming out of. Yeah, well for a residential piece. Correct. One of the things that I wanted the state to clear if if you know, I just want to make sure is that what is happening? That's right. Okay. So I'm okay with withdrawing with with accepting their withdrawal right now. And I think [2:19:18, 2:19:28]: I think that um you know, once everybody gets everything together, once they come back to us, if they if they decide to come back to us, [2:19:28, 2:19:36]: then we can take it from there. By then we will have every all the information from the state. There's nothing for us to vote on at this time. [2:19:36, 2:19:56]: Thank you. And Ms. Gantt, one of the things that we also asked the state to provide for us because it is C2, how much commercial? If you came in tomorrow and said, I wanted to put 250,000 square feet on 22 acres, right now I would have to permit them for all those thousands of cars unless the state comes back and says, [2:19:56, 2:20:16]: Say, you've exceeded Walmart, so I can't allow you to do a strip center there. And so we really need for them to clear up even on the commercial. How much commercial and cars will you allow us to do on this 22? If we don't do residential, and if someone comes in tomorrow with a commercial strip, what are you gonna allow the city of Stockbridge to do? [2:20:16, 2:20:20]: Until they tell us, we would actually have have to permit it because it is zone C two. [2:20:21, 2:20:41]: I understand that. And and also, excuse me, Mayor Baume. Um there was a comment made about the law, and that's correct. The law does state that, you know, we can't look at the education and the impact of the citizens. But, you know, laws change every day. And we need to start considering those things that will impact us in our neighborhood. [2:20:40, 2:20:53]: neighborhoods and in our community. And we need to work together. That's county, border education, cities, all of us have to work together to make sure that we are [2:20:53, 2:21:13]: Doing what's right for the citizens and doing what we want. I mean, we can't even it is be coming to the point where we can't get out of our neighborhoods. Everybody has learned all the back roads. We don't have any main access roads right now, as others locations may. And so we have to pull together and come up. [2:21:13, 2:21:33]: With some ideal situations and advocate for those. And so I don't care. I care about the law. I'm gonna follow the law, but understand that we still have to appreciate and understand and work with our board of education. My children in school, I don't want 35%. [2:21:33, 2:21:41]: Five kids in a classroom. So it does matter. It matters. It matters all the way around. And we need to start considering that. [2:21:42, 2:21:42]: All right. [2:21:42, 2:21:46]: Any more questions right now, concerns? Yes. Go right, please. [2:21:47, 2:21:51]: Mr Knighton, did you have something you want to add to this before I say something I saw you uh [2:21:52, 2:21:53]: Okay. [2:21:53, 2:22:10]: We were I was speaking to the uh city attorney because I I wanted to make sure of the withdrawal requirement. In other words, if the application is withdrawn, what period of time would would the applicant have to wait until they would be able to to bring any like application back? [2:22:10, 2:22:12]: And I think Mike is [2:22:14, 2:22:25]: So so basically if you were to deny it, they would have to wait a year before they could bring any application, whether it's for commercial, residential, whatever. So that's what we're confirmed. [2:22:25, 2:22:26]: Yeah, for [2:22:27, 2:22:31]: Withdrawal they can they can reapply whenever they want. [2:22:32, 2:22:52]: You you so you're looking that up. Yeah, so they've withdrawn, so it doesn't matter. Okay. Okay. So go ahead, please. But that but that still let's get clear on the withdrawal process, then what does that mean for us? It's just withdrawn until the owner of the property decides to bring it back. There's only a time restriction if action [2:22:52, 2:23:07]: is taken. If an action is if an application is withdrawn, there is no time period. I just want to say this is that when we set up and and we we shouldn't have this type of look in front of the public. [2:23:08, 2:23:28]: Because when we set up and have meetings and we sat down and we talk about this and we methodically move and we sat and we orchestrate what we're gonna do behind closed doors. When we come out in front of the public, they're expecting us to see us move and not sit here and and each council member have no idea what's going on. It's not a good look. [2:23:28, 2:23:31]: it doesn't feel good to me because I spent my time [2:23:32, 2:23:35]: Coming up here to City Hall and having meetings with all of you. [2:23:35, 2:23:37]: Pertaining to this project. [2:23:38, 2:23:41]: And then to come here and have it so convoluted. [2:23:41, 2:23:49]: like this is not a good look and it's not a good feel because what you all have done is told us that a developer can come in here. [2:23:50, 2:23:55]: And by s by text can say, I don't know if it's gonna pass or not. [2:23:55, 2:23:56]: Let me remove it. [2:23:58, 2:24:05]: I can look at it on this these videos and it doesn't look good for me. Let me go ahead and remove it. That's not the process that we have here. [2:24:06, 2:24:08]: But that's the standard that we're setting tonight. [2:24:08, 2:24:10]: And it's not a good look for none of us. [2:24:11, 2:24:14]: Да небарі ки камінні с сити. [2:24:15, 2:24:17]: And say I wanna build anything. [2:24:17, 2:24:19]: And they can look on those cameras at home. [2:24:20, 2:24:24]: And say it doesn't look good for me, go ahead and remove my application. [2:24:25, 2:24:31]: That's not a good feel and not a good look. And I'm telling you, that's that's not what the citizens elected us to stand for. [2:24:31, 2:24:47]: And let me just say, Mayor Pro Tem, we took over, um, and I will say this again, we took over zoning in April. Fully took it over. Um, and the city has only had two DRIs. That's Jody Cole. Miss Moore, I'm sorry to cut you off. Okay. [2:24:48, 2:24:50]: But when we looked at this D R I [2:24:51, 2:24:53]: This isn't something that I'm speculating. Mm-hmm. [2:24:53, 2:24:56]: We knew it was over fifteen years old. [2:24:57, 2:25:12]: We knew that. We knew that the DRI standards was already out of bounds of what it should be. We knew that. When we had the meeting, everything told was told to me that it was a go. Then I knew that. And then to come here and have this, that's unacceptable. [2:25:12, 2:25:24]: It's just unacceptable for us to operate like this as a city, being transparent with the ones that are here. But when your legal department tells you that you have to have something and write in Marepro Town. [2:25:24, 2:25:33]: I, as your planning director, followed those instructions to protect the city. And as soon as he told me that I needed it in writing, I reached out to Greta. [2:25:33, 2:25:36]: Greta's the one who said that they couldn't have it here by today. [2:25:37, 2:25:48]: And and and I again I apologize um for this. The information that we got, uh the clerk graciously we were able to track it down on Tuesday and we proceeded to do what we could last week. [2:25:49, 2:25:51]: All right, Mr uh Ms. Thomas, go ahead, please. [2:25:52, 2:25:55]: Uh I'm gonna agree with Mayor Pro Tem Blount. [2:25:55, 2:26:04]: I'm gonna agree also with Councilwoman Gantt about the oversaturation of development, transportation, not keeping up with that. [2:26:04, 2:26:11]: But as I said earlier, d th this is my biggest problem here, and this is where I agree with Mayor Pro Tem. [2:26:13, 2:26:16]: This development didn't start yesterday. [2:26:17, 2:26:20]: This been in the pipeline for a while. [2:26:21, 2:26:29]: And staff are hired to research, do all of the preparation. [2:26:30, 2:26:37]: before it comes to us, before it was put on an agenda, somebody failed this council somewhere. [2:26:39, 2:26:45]: This shit not even been on the agenda according to what I'm hearing now. And this is where I'm going to agree uh with Mayor Pro Tem. [2:26:47, 2:26:51]: Someone can see this meeting and say, Okay, it's not looking well, let's withdraw it. [2:26:53, 2:26:54]: I have a problem with that. [2:26:56, 2:26:57]: Again. [2:26:58, 2:27:00]: You all are hired to do a job. [2:27:02, 2:27:07]: We are hired to vote to put things into place. [2:27:08, 2:27:17]: Y'all have put us in a very, very bad position here because somebody failed this council. Somebody here did not do that homework. [2:27:18, 2:27:26]: And I say this all the time. This is nothing new that I'm saying to the staff. I'm just saying it in public right now. And y'all know I say this every day. [2:27:27, 2:27:35]: Do your homework. That's what you're hired to do. So when you come to counsel, come to us with the facts and information. Don't put us in this position. [2:27:36, 2:27:38]: And I'm really ticked off about that. [2:27:40, 2:28:00]: All right. Any other comments from the council? Yes. I'll go right up there. I just want to close by saying this, okay? Understand this. I didn't get an answer from Mr. Williams about my question. Please understand one thing. I'm not telling you that we don't we sh we're gonna disregard what the school system is doing. I'm not telling you that at all because I live in the community. [2:28:00, 2:28:20]: Granddaughter goes to flipping elementary school. What I'm telling you is if you vote and you vote it down and then they take you to court and then you end up paying uh$500,000 for damages, and then they get the development anyway, that is a problem. That's when the law tells you that this development [2:28:20, 2:28:35]: is going to be improved. That's why we go to the city attorney and say, you know, Mr. Williams, what do you think about this particular development or this particular assessment? Yes, of course we want to consider that. But what I'm my statement to you was go to the school board. [2:28:36, 2:28:56]: Ask them for their plan on where the new schools are going to go. They have a plan, they just aren't sharing it with you. Yet we have people go to the county zonings and they come to these zonings and they tell us about the school board. The school board is a self-contained entity, they make all [2:28:56, 2:29:01]: All of their own decisions with seven hundred million dollars of your money. [2:29:01, 2:29:15]: We need to hold them accountable about what they're doing in the community, how they're not keeping up with what's going on at the schools. Where we're they just built a new school in McDonough, right? They built a new high school there. [2:29:16, 2:29:33]: Where is the next high school gonna be at in Stockbridge? They already know. They're just not telling you where it's going to go. So as the same thing as you coming to this meeting talking to us about what's going on in the community, many of us, when I go to the school board meeting, I've been to the meeting many a time. [2:29:33, 2:29:35]: There's two people there. Two! [2:29:36, 2:29:56]: One or two people attend the meeting, yet they got$700 million of your money. And anytime we try to bring a project to you, it's affected by the school board. The school board and the schools, the classroom sizes are growing. What are they doing to address those issues? That's a question that you need to ask them at their perspective. [2:29:56, 2:30:16]: Particular meeting while we we deal with these issues because growth is coming. We just had a study come out that 6,000 people moved to Henry County last year alone. The projection calls for nearly 400,000 people to be in Henry County. They're coming, ladies and gentlemen, whether we want them to come or not, they're coming. [2:30:16, 2:30:36]: The issue is I'm not gonna pass the book. It's my job to fix the roads. It's the commissioner's job to fix the roads. It's the school board's job. Okay, we can keep blaming the developers and say, go away, go away, go away. No, we got to do a better job of uh managing traffic and transportation and the school board. [2:30:36, 2:30:41]: [9042.1, 9050.2]: Thank you very much. Now on this note, so it's been withdrawn, so w they'll come back another time and we'll have a public hearing some other time in the future, I suppose, whenever it comes back. [2:30:50, 2:30:53]: They would have to start over from the very beginning. [2:30:53, 2:31:13]: All right. All right, and John Palmer, Mr. Palmer, as your the representative, I'll know you take this all back to them and and regroup and whatever the case is. So it's no need no need to take a vote on a table. It's been tabled, so no need to take a official vote on that. Is that correct? No d no need to take official vote on on on this issue. Okay. All right. Council number [2:31:15, 2:31:35]: Withdrawing. Oh not to withdraw, excuse me. Withdrawn. All right. Councilman number nine. Council. I'm sorry. Along that discussion, let me say this. I do think that, you know, if in the future the council wants to entertain some type of penalty, if you will, for withdrawal of an application, for instance, six months or eight months, whatever. [2:31:35, 2:31:55]: Whatever that is, then that could potentially remedy s situations like this when there is a withdrawal of an application. I think that there are zon other zoning codes um that can't hear you this. I'm sorry. There are other zoning codes that do um have those types of um provisions. If you withdraw, you can't come back for six months. [2:31:55, 2:32:01]: six months, eight months, whatever that time period is, which could in future alleviate some of the concerns we've heard here. [2:32:01, 2:32:21]: All right, that would be a resolution you're saying, or that has to be a resolution we decide to do something like that? We could just update the ordinances when we bring them to you for you to consider that penalty. All right. So I guess you take that on as a task and to to do do go through that process. Okay. Yes, ma'am. So uh I guess all that we're getting out of this we're gonna penalize. [2:32:21, 2:32:41]: For era that we had? Is that what I'm hearing? No, that's not what I'm saying. No, that's not what I'm saying. Okay, so he's saying when we update the ordinance to have a provision to address council concern that someone doesn't just watch the screen and decide to withdraw. That in the new adoption of the ordinance, you will have language that says. [2:32:41, 2:32:42]: Yeah. [2:32:42, 2:33:02]: If someone submit an application and they withdraw it, that they would have to wait six months before they could not this case but future in the future. Go back through the process. There would be a waiting period of six months. So we're done with this for now then. And the applicant can leave. Okay. If you choose. Right, we're done with this. All right. [2:33:02, 2:33:22]: Number nine, council consideration to approve uh purchase of fire marshal uh vehicle and equipment at an amount of fifty-five thousand two hundred and forty-three dollars, funding source general fund. Miss more, please. That's correct. As you know, um we brought on a fire marshal, and one of the things that the state requires is that we have him in compliance, which means that there needs to be a vehicle that says five. [2:33:22, 2:33:33]: I'm Marsha with all of the red flashing lights. Uh so we just need to amend the budget so that we can go ahead and get the equipment and the truck ready for him to use. And that's what this item is before you tonight. [2:33:33, 2:33:35]: Any questions from Miss Moore? [2:33:36, 2:33:38]: And then emotion then council to [2:33:39, 2:33:58]: Uh so yes ma'am. I I have a question, Mayor. Where is the money coming from we are if we amend the budget? Amending the um building and permitting budget uh based on our portion of the um the fees that we generate that comes out of our portion of permitting. [2:33:59, 2:34:19]: So out of permitting fees that are generated, you're gonna add a line item to deduct the fire marshal from that from that section. Because the fire marshal is in that budget. Permitting and fire are all in the same building and permitting budget. So we're gonna do a line item to adjust that budget for these. [2:34:18, 2:34:22]: items that come out of that budget based on the revenues that we received. [2:34:23, 2:34:25]: Do we have a [2:34:27, 2:34:46]: We already have a line item for the fire marshal already, correct? We do, but we don't have a line item that deals with the there's a vehicle line item there it says zero. There's an equipment line item it has zero. So are there any other funds within that budget that can be shifted to that line item? No ma'am. [2:34:48, 2:34:52]: But it is we will take it out of the revenues that come in, so we will drop them in that. [2:34:53, 2:35:13]: Well, I but I wanna make sure I I know you say you take it out of the revenues, but if we're gonna pay for it now, then where's the money gonna come from? It's gotta be there. We're running a surplus and finance could talk to that based on our revenue side. Permit is running a surplus this year. Okay. So it's out of that surplus that we're taking the vehicle and [2:35:13, 2:35:15]: Mm-hmm. [2:35:16, 2:35:17]: All right. [2:35:17, 2:35:36]: Uh no council still need a motion to um purchase this fire marshal or vehicle for the fire marshal. So move. I second. I have a question before you vehicle and equipment. Vehicle and equipment. I'm sorry. Motion made by Alexander. Seconded by Ms. Cat. You sir have a question. [2:35:37, 2:35:52]: So you say it's gonna be taken out of revenues brought in by permitting. Correct. If you didn't do this with the revenues by coming in by permitting where would the revenues go? Well then we would have to find it from another source. It's just that we're blessed to know that we're running a surplus and permitting this year. [2:35:53, 2:35:55]: No, that's what I'm saying. If it didn't go [2:35:55, 2:35:58]: to this, where would the revenues from permitting go? [2:35:58, 2:36:04]: Oh, we just keep it in there. It goes anywhere you choose to use it. So with these are revenues that would actually go into the fund balance? Correct. [2:36:05, 2:36:24]: So why wouldn't we just bring it to pay for it out of the fund balance? Because it it it has to go into a budget. So while it sits over there, when the money comes in as surplus, you still have to take that money from the fund balance and allocate it to a budget. So that's what this does tonight. It takes it and actually puts it in the vehicle amount. [2:36:24, 2:36:44]: It'll put some money there and then an equipment amount, it'll put some money there. So you're doing a transfer of funds. Yeah, I get that. But what I'm saying to make it clean for us, for me, is that we go ahead and line item that out of fund balance and then the revenues coming in from permitting just let whatever comes in, and we don't know what numbers those are. Okay. Just let those go into fund balance. [2:36:44, 2:36:49]: I mean wouldn't that be easier to do it that way? Okay. [2:36:50, 2:36:52]: Obviously, the side. [2:36:54, 2:36:55]: By Miss Wiggins. [2:36:56, 2:37:16]: How's it going? Mayor and Councilman. That's exactly what we're gonna do. What what uh Councilman Blount said. It's it's gonna come out of fund balance. You have revenues are just gonna cover it at the end. And that's basically um how how this procedure is gonna uh go. But we'll we will bring to you later on, probably in December, uh [2:37:16, 2:37:20]: uh uh a budget amendment that would address that. Okay. That's it. [2:37:21, 2:37:23]: And then a question is for Miss Moore. [2:37:25, 2:37:27]: Motion was made in a second. All in favor of the motion, please indicate. [2:37:27, 2:37:28]: All right. [2:37:28, 2:37:33]: Uh all polls? Oh you you you affirmative? Okay. Okay so you name it. All right, good deal. [2:37:34, 2:37:47]: Council consideration to approve job description, organizational chart, and reclassification of utility billing clerk to financial services technician. Miss Wheeler, please. Along with Mr. Wiggins, it says here, sir. Okay. [2:37:48, 2:37:49]: Hmm. [2:37:50, 2:37:51]: [9472.6, 9472.9]: Oh. [2:37:54, 2:38:09]: Good evening, Mayor and Council. Good evening. Um you have before you a staff recommendation to reclassify one of the utility building clerk positions to a financial services technician. [2:38:09, 2:38:21]: By uh reclassifying this position, it would uh provide additional duties that are needed in the uh finance department or this one particular position. [2:38:22, 2:38:31]: Okay. Any questions counsel for Miss Wheeler or Mr. Wiggins in reference to this and the funding aspect and the changing of the job description? [2:38:33, 2:38:37]: Okay, no questions and I need a motion to accept a recommendation here. [2:38:37, 2:38:38]: Some of the [2:38:39, 2:38:43]: Okay, motion again, seconded by Robinson. Any further questions? [2:38:43, 2:38:48]: If not all approved that all in favor of the motion, please indicate. Okay, fantastic. [2:38:49, 2:39:00]: All right. Council consideration to amend chapter two point one two, administration to formally assign financial finance powers and duties to the city treasurer position. Miss Wheeler, please. [2:39:00, 2:39:06]: Um in the uh chapter two point twelve, I guess it's in the charter under administration. [2:39:06, 2:39:12]: We're moving the the formally assigned the finance powers and duties to the city treasurer position. [2:39:14, 2:39:15]: A second. [2:39:15, 2:39:19]: All right, is there any discussion on that? Motion been made in the second. Any discussion? [2:39:20, 2:39:22]: If not all fair, please indicate. [2:39:23, 2:39:24]: All right, unanimous as well. [2:39:25, 2:39:26]: Thank you. [2:39:26, 2:39:27]: Thank you. [2:39:27, 2:39:38]: Council consideration to approve minimum development standards for water, sewer, stormwater, and roads as prepared by the city stockbridge engineers Carter and Slew. Mr Aaron, please. [2:39:38, 2:39:58]: Yes, good evening, Mr. Mayor and Council. We're coming for you tonight to ask that you'll approve the development standards that would guide how we inspect and allow extensions to our water, sewer, and stormwater system and as well as our roads. Currently we're following Henry County specifications, but there are some things that we want to do. [2:39:58, 2:40:05]: differently that addresses specific issues in stockbridge. So we want to have us a guideline of how we address those issues. [2:40:06, 2:40:07]: Alright. [2:40:08, 2:40:16]: Counselor, any questions for Mr. Aaron? Go right here, please. Mr. Aaron, I thought we had um Mr. Knight when we talked about [2:40:16, 2:40:35]: This pertaining to when we was gonna do the analysis for the road and for the uh sidewalks. I thought that we had we had removed ourselves from the county standards and that we had we were setting a standard for ourselves pertaining to those uh this this is something different than road assessment. Yes, sir. [2:40:35, 2:40:45]: Previously, the city had an agreement with Heron County Water Authority that they would come out if you did an extension to your water system or sewer system, Herring County would inspect it. [2:40:46, 2:41:06]: And and we've taken ownership of some things we probably shouldn't have taken ownership because we weren't there doing the inspections. Now we're at the point we're doing those inspections because we have the the knowledge and expertise on board, so we wanna do our own inspections for our water source system. Now quick question then. [2:41:06, 2:41:14]: Will we take on will we incur any um expenditures pertaining to this versus what we already pay in the county? No, sir. Okay, got you. [2:41:16, 2:41:18]: Any other question from Mr Erd? [2:41:19, 2:41:39]: Mayor. Yes, Mayor. I move that we um approve the minimum development standards for water sewer, storm, water, and roads as prepared by city stop engineers. There are a second. Second. Mr. Blount, it's a second. Um all in favor, please indicate. I'm sorry. I did have a question. I'm sorry. She made the motion before. I won't [2:41:39, 2:41:47]: But I do wanna know what the main difference is between the Henry County standard and then the standard that we're changing to. How is it better? [2:41:48, 2:42:06]: How's it better? Yes, if we're doing that what they're doing, we're are we doing something better than what they're doing? Are we doing something that is totally unique to us that's specific to the city? Why give what is the difference between what they're doing in layman's terms?'Cause I don't we weren't gonna be able to understand it otherwise. [2:42:06, 2:42:26]: There were just some some of the materials that you use for water and sewer extensions, also how they're installed and some of those requirements that you put on a developer as far as testing and things of that nature. And when Heron County was doing it, we weren't at the table when they were doing the inspections. And also we didn't have anything in place that can [2:42:26, 2:42:38]: capture stormwater or the construction of roads. So we wanted to make sure that we were able to inspect those as well. Their standards versus our standard, which one is better? [2:42:38, 2:42:58]: I I don't want to get into that. I'm just saying we're adopting standards that are beneficial to the city of Stockbridge. And we didn't do it from a comparison standpoint. We just did it for the benefit of the city of Stockbridge. Because what's beneficial to the Herring County Water Authority, they're completely different than what we're doing, and it might not be beneficial. [2:42:58, 2:43:17]: To the city of Stockbridge. So we're just doing what's beneficial to the city. Well, I'm asking it if something prompted you to bring this forward. What what issue prompted you to bring this forward? Because we currently have the expertise on staff to do our own inspections. And we wanted to make sure we incur [2:43:17, 2:43:24]: We encountered some things in the field that we weren't satisfied with. So we wanted to be able to do it ourselves to [2:43:25, 2:43:32]: Do you know as you can say control our own destiny when it comes to the Okay, that's understandable. Thank you. Any other questions from Mr. Aaron? [2:43:32, 2:43:37]: If not but the motion is made, it's been seconded, so all in favor of the motion please indicate. [2:43:37, 2:43:38]: All right, thank you. [2:43:39, 2:43:48]: Unanimous. All right, council consideration uh to approve the amendment to the city gateway beautification contract with CGL [2:43:48, 2:44:00]: Facility maintenance uh excuse me, facility management L L C and the city under state of Georgia contract number nine nine nine nine dash zero zero one. Yes, sir. [2:44:01, 2:44:02]: We skipped the spot. [2:44:02, 2:44:03]: I skipped one. [2:44:04, 2:44:06]: Excuse me. My eyes had [2:44:06, 2:44:08]: There's a c wait a minute now. [2:44:08, 2:44:11]: My eyes are deceiving me. Thirteen. I'm on thirteen. [2:44:13, 2:44:25]: Hey, Mr. Aaron, can I use your glasses please? No, okay. Anyway. Council consideration to to approve bid award recommendation for roadway s resurfacing in the amount of one million three hundred twenty two dollars. [2:44:25, 2:44:27]: In four hundred and fifty eight [2:44:27, 2:44:31]: Thousand, well the hundred Yeah, one million. Three twenty two three two two. [2:44:31, 2:44:35]: Five four five eight one thirty two cents funding sources. DOT grant [2:44:36, 2:44:42]: Of two mid what's that two hundred ninety one thousand three hundred six sixty one fund balance six hundred fifty thousand. [2:44:42, 2:44:49]: Previously approved and fund balance in splots of three hundred eighty one thousand one hundred fifty one and seventy one cents. Mr. Aaron. [2:44:50, 2:45:10]: Uh yes, Mr. Mayor and Council. Uh the city manager and I have had several discussions. Right. When we initially came before council, we had a cost estimate based on the previous mileage that we do every year. We've done five miles a road a year. But one of the things about uh resurfacing and things of that nature. [2:45:10, 2:45:29]: is the prices are tied to the cost of petroleum when gasoline prices go up, asphalt prices go go up as well. So we've got a shortfall and we're just trying to uh supplement that so that we can continue to pave the five miles of road that we've typically resurfaced. [2:45:30, 2:45:50]: All right, Mr. Aaron. Okay, so this is um this is based on the the the yearly of the really projection of all the roads that we want to resurface in the in the community, is that correct? Yes, sir. The city has eighty-five miles of paved roads in the last three years. We resurfaced 15 miles, so this at another five miles, we'll be at twenty miles we that we resurfaced. [2:45:50, 2:45:55]: surfaced in the last three years. Okay, thank you sir. Any other third questions for Mr. Aaron? Counsel? [2:45:56, 2:45:57]: If not I need a motion, please. [2:45:58, 2:46:10]: Mayor, I move that we approve the VID Award recommendation for recommendation for roadway sur resurfacing. Okay, Ms. I was not second that. Uh any further discussion? If not, all in favor please indicate. [2:46:10, 2:46:15]: Right, fantastic. Okay. Now I can go to fourteen this time. All right. [2:46:15, 2:46:35]: Council consideration to approve the amendment of the City Gateway Beautification Contract with CGL Financial Facility Management LLC in the city under the State of Georgia contract number nine nine nine nine-001 dash SPD 0000154-001. [2:46:35, 2:46:45]: Facility maintenance solutions. City of Stockbridge Procurement Contract Number 2019-00022P. [2:46:45, 2:46:59]: Groundkeeper, Landscaper of Public Works Department, modifying the scope of services, Wall Stephen Road, Old Atlanta Road, Flippin Road, Davison Parkway, and East Atlanta Road, and increasing the overall estimated contract amount to two hundred thousand. [2:46:59, 2:47:06]: Annally and uh comes oh Mr uh Mr. Aaron, please, along with uh Miss Miller. [2:47:06, 2:47:20]: Good afternoon, Mayor and Council. Uh just like you said, we're asking you to amend the contract. We did bring this contract to you previously for sixty-eight thousand. So we're asking you to amend it for an overall two hundred thousand to include the additional locations. [2:47:22, 2:47:24]: Okay, is there any qu any questions for [2:47:25, 2:47:32]: Two staffers here on this at all. If no questions under the motion then. So moved. Okay. [2:47:33, 2:47:33]: Is there a second? [2:47:34, 2:47:34]: What [2:47:36, 2:47:37]: You have a question? [2:47:38, 2:47:44]: I have a question because it says two hundred thousand dollar increase. Is that what I'm reading? [2:47:44, 2:48:04]: Two two hundred thousand. It goes to two hundred thousand. I believe it's a little bit. Well, we're this will cover us to the end of the year. We have the funds available in in the personnel with temporary staffing. This year we've had an issue with personnel uh bringing on board temporary staffing. So we still have about eighty thousand dollars left in that funding. [2:48:04, 2:48:24]: So the money that we're requesting will take us to the end of the year. We have sufficient funding to add the additional roads. And next year, one of the things we did, we budgeted for having the right-of-way mowing and maintenance so that if we don't get the uh temporary staffing, we normally [2:48:24, 2:48:44]: Get will ensure that certain uh gateways are maintained in a more expeditious manner in that they'll be maintained weekly. Those are like uh Rock Warriors, Hudson Bridge, it'll be Old Atlanta Flipping, uh East Atlanta, Davidson Parkway, Highway 138. [2:48:44, 2:48:55]: And if there's some additional streets during the year that we wanna add, we'll have the resources available to add those additional streets based on whether we get the personnel from temporary staffing or not. [2:48:56, 2:49:16]: Okay. Once again, you you good? I'm okay with that. You good? Ms. Alexander. I just Mr. Aaron, I appreciate you bringing this to us because this is something that is a part of the overall beautification plan that we've been working on for the city. And it's showing up when citizens drive down Rock Cory Road, they're noticing it. When they go to Hudson [2:49:16, 2:49:27]: Bridge, they're noticing it. I I've noticed the difference on highway one thirty-eight uh at the exit. Uh I think we're still working to get the edging done. Is that correct, Mr. Knight? [2:49:29, 2:49:31]: We're gonna continue to work on yes. [2:49:31, 2:49:51]: Yes, because it's important when people get off the exit that it's not litter clutter. It's not litter there. It looks in a superior fashion. And we've been anchoring to do that because it helps is everybody wants to see uh good business. You wanna see upscale businesses, you wanna see nice shops, restaurants. They don't want to pull off the exit. [2:49:51, 2:50:01]: and see it trash. They don't want to see dilapidated buildings. They want to see beautification. And that's something that we were long overdue on. And Mr. Aaron just told us something that was very key. [2:50:01, 2:50:04]: The seasonal workers aren't working. [2:50:05, 2:50:25]: I don't suggest that we ever go back in that direction. I think we should move in this direction where the private contractors maintaining it. They're doing a great job. But the seasonal workers are making$8 an hour or whatever that pay may be on 95 degree day. That's not working. So I don't even want to look back in that direction. I want to continue what we're doing. [2:50:25, 2:50:30]: where we're having pro hiring private contractors and I fully support this particular measure. [2:50:31, 2:50:43]: Right, um Mr. Blount. I believe Ms Blount had comments. Yes. Um Mr. Aaron, so so you're going from sixty eight up to two hundred thousand or it's two hundred thousand additional. [2:50:43, 2:51:03]: 200,000 would be next year fully funded for the entire year. But now we're just trying to get through the end of the year. We've got about 80,000 left in the temporary staffing. So this would cost us probably an additional ten thousand or ten or fifteen thousand dollars to make it to the end of the year to add to additional. [2:51:03, 2:51:03]: Street. [2:51:04, 2:51:10]: Mm. Do you find you using less staff because of when the s the g this time of year when the grass started going dormant? [2:51:10, 2:51:30]: Well, the thing about it this whole summer it's just been an ongoing battle to to obtain temporary staffing. We've got I think five different agencies we've been reaching out to. But we know that grass needed to be cut and we want to ensure that those areas are maintained. Because like I said, we've got a lot of compliments about Rock Quarry Road. [2:51:30, 2:51:50]: That road is mowed every Wednesday. So the look is a a lot better than it was in previous years when we had temporary staffing. Well, I'm I'm good with whatever we're doing to beautify the city, but I would I would would that we would get something feasible to show us what staff that we have and what we're [2:51:50, 2:52:10]: capable to do as a city before we go into kind out outsourcing contracting because we want to make sure we're maximizing those people and it's no beliterate to you maximizing those people that we do have on staff for for our area and city of Stockbridge and then if we need to bring in that uh bring in uh an outsource [2:52:10, 2:52:14]: [10334.3, 10354.3]: So we're using the contract to supplement what what we're doing now because when you take into account of hiring an employee benefits and providing equipment for those employees and and working around vacation time and sick time and those kind of things, the the contract is making it a whole lot cleaner where you know every Wednesday when he says he's gonna be a good thing. [2:52:34, 2:52:38]: gonna show up regardless unless something catastrophic happen, he's gonna be there on Wednesday. [2:52:39, 2:52:59]: And the reason I said that, Mr. Aaron, is because we've as this council since I've been on since 2016 has always asked, what do you need? What do you need? What do you need? And the answer's always been, we all right, we good. And so this in the last eighteen months, I've seen more contract working. [2:52:59, 2:53:01]: workers than I've ever seen since I've been here. [2:53:02, 2:53:22]: Because uh and I and I give Lyndale all the credit for that. She went out and found us a vendor because we were having issues with the temporary staffing. We normally have between ten and fifteen temps coming in on a daily basis. Now when you have two to three, it's a whole lot different. When you're trying to get the same work out of two [2:53:22, 2:53:31]: two to three that you were getting out of the ten to fifteen. And I just compliment her on reaching out and finding a vendor that can help us help supplement the mowing [2:53:33, 2:53:33]: Go. [2:53:33, 2:53:53]: I would I would if I could. I I would add one thing real quick. The the private contractor helping us to supplement some of the mowing um is some of that's coming out of the the cost of what it would have been to hire temporary staff. That's what you would say. And so then in next year's proposed budget, we would reduce would prop [2:53:53, 2:54:06]: propose reducing what we had in this year's um budget in terms of temporary staff which which were responsible for mowing and litter pickup and those types of things and devote those funds to the state contractor. That's our proposal. [2:54:06, 2:54:18]: Mayor. No, no. One second, please. Mr. Thomas. Right. Thank you, Mr. Mayor. Uh Mr. Aaron, I I wanna say first I agree with the end results of way things look. I agree with that. [2:54:19, 2:54:21]: Uh, but I'm concerned about [2:54:21, 2:54:25]: And I know we've had this conversation before about [2:54:25, 2:54:31]: areas that are not in the city of Stockbridge. So some of these areas are not in the city of Stockbridge. Is that correct? [2:54:32, 2:54:48]: N the only road that ends in and out of the city is Rock Quarry Road. But the other roads, they're within the city limits that we're maintaining, like Highway 138, Henry County, and we're previously mowing and maintaining that section of road of Henry County. [2:54:49, 2:55:03]: Henry County was and then they gave it back to us, so we had to pick up that section on one thirty eight. So and I and I guess I'm going to the talk, you know, we've asked [2:55:04, 2:55:15]: Many times is is there a conversation with Henry County, Clayton County about these projects. But again, I'm I'm good with the end result. I just want to just follow up with that. [2:55:15, 2:55:32]: We've had several meetings with with Clayton County. We met I think at McDonald's. It was Clayton, Heron County, and the city of Stockbridge, about that one thirty-eight area, from six seventy-five to seventy five, then seventy five down the Spears Spear Road. So those conversations have been had. [2:55:32, 2:55:52]: And I and and I'll just say I'm just putting this in the record. You know, we have two county commissioners that represent the city of Stockbridge. I just want to put that in the record. My last question, um, is this increase or these funds is it reflected in the uh 2020 budget, your twenty twenty budget? Yes, sir. We we sat down with Mr. Knight and we had a [2:55:52, 2:56:09]: a conversation we budgeted for the city had previously I think in this year's budget it was a hundred thousand dollars for beautification so in the twenty twenty budget we took funds from the temporary staffing to make to make up the difference for the uh beautification. All right thank you [2:56:10, 2:56:12]: Ms. Gat. I second. [2:56:13, 2:56:32]: Wait, we made the motion the first time? Council. Further, any further discussion? All in favor, please indicate. Okay. Fantastic. Uh what's next is number 15. Council consideration to approve the pond company for construction program management of the public works administration building and the amount of [2:56:32, 2:56:38]: One hundred and twenty six thousand two hundred and fifty dollars. Funding source would be splot. Mr. Aaron, please, with Miss Miller. [2:56:39, 2:56:59]: Yes, Mr. Mayor. Uh when I came on board, the city had already employed the services upon company to design the public works facility, but they never had an agreement once the building was designed and and bidded out for anybody to oversee the construction. So we're coming back tonight asking you to approve to allow [2:56:59, 2:57:19]: to oversee the construction of the public works building. It was$3 million allocated in SPLOS. The the bid, the lowest bid was$2.1 million something. So we're still on the budget. We have the funding available for the project management and we're asking you to approve that tonight so we can move forward with the construction of the public works building. [2:57:20, 2:57:29]: Okay, ma'am, you got your hand up or or any qu yeah, go right ahead. I'd like to make a motion to approve um the Pond Company for construction program management of the Publix Work Administration Building. [2:57:30, 2:57:33]: A second. Okay, Mr. Tom, a second is so any questions on this at all? [2:57:35, 2:57:37]: Did you take it a second? I thought I heard Ms. Robson as well. [2:57:38, 2:57:40]: No, Mr. Thomas, I don't think second that. [2:57:42, 2:57:50]: All in favor of the motion, please indicate. Okay. And you you got uh not anonymous, you're missing one. Okay. All right. [2:57:50, 2:58:03]: Number sixteen, council consideration to approve ranking of bidding bidders and authorized negotiation of contract uh construction contracts for an amphitheater. Mr. Knight and Miss Miller and I believe Miss Moore is the obness as well. [2:58:05, 2:58:06]: Okay. [2:58:10, 2:58:11]: Yeah, please. [2:58:18, 2:58:20]: There you go. [2:58:21, 2:58:41]: All right, Mayor and Council. Um, it gives me uh great honor and privilege to bring this item to you tonight uh related to uh a potential contract award and bid award uh for the amphitheater project. Obviously, this is something that the uh council um has um uh had great vision for uh for why. [2:58:41, 2:59:01]: Citizens have been yearning for it, and we're at a place now where we can bring this to you for your uh consideration. Uh, just by way of uh information and history for the public, uh, this amphitheater project is not something that has come about on a whim. This was a part of a Livable Cities initiative many years ago. [2:59:01, 2:59:21]: As a part of revitalizing the downtown area. Obviously, the proposed amphitheater would take place adjacent here to City Hall. And then about a year ago, the council made a very strategic move to acquire 6.75 acres next to that property. [2:59:21, 2:59:41]: To help supplement the amphitheater project. Just by way of graphic information for the public, these are represent uh renditions of the amphitheater project, the wheel call office you can see there. And then here, obviously, you can see. [2:59:41, 3:00:01]: The large amphitheater area. And just by way of information, obviously these are the wheel call areas. There's box seating here, terraced seating here, and then fixed seating here, and VIP seating up on the stage. To the right, you see the green room area. [3:00:01, 3:00:05]: with an elevated terrace are for viewing as well. [3:00:09, 3:00:29]: It's another uh picture, uh rendition of the amphitheater project. You can see the stage area uh in greater detail, as well as again the fixed seating and the terrace seating, which offers uh different uh viewing opportunities uh for those who will come and be a part of uh the entertainment. [3:00:29, 3:00:45]: At the Amphitheater. I will tell you that with our architect uh Turner Spangler and Walsh, TSW, we've been at this for quite some time. Uh at the very early stages of this, uh, we did invite a number of professionals uh in the industry. [3:00:46, 3:00:58]: uh people who were astute in lighting in sound in stage uh in seating uh customer experience and we had a very long and uh uh significant conversations with them [3:00:58, 3:01:01]: our uh architect team [3:01:01, 3:01:06]: Uh, took all of those things into consideration in developing concept plan, development plan. [3:01:06, 3:01:26]: And then ultimately a 100% construction plans. And so obviously, this is something that has been widely anticipated. I will allow um uh both Lindell and Camilla to uh speak further about this, and Lindell will talk about uh the processing for the um proposed uh bid award that we have before you. [3:01:26, 3:01:27]: This evening. [3:01:28, 3:01:29]: Thank you. [3:01:32, 3:01:33]: Just click. [3:01:37, 3:01:47]: Good afternoon again. Afternoon. Mayor and Council. Uh the city manager on behalf of the city manager, uh the procurement division is requesting council approval. [3:01:47, 3:01:51]: To award a contract to HJ Russell and Company. [3:01:52, 3:01:56]: The responsible and responsive bidder whose proposal was determined in writing. [3:01:56, 3:01:58]: To be the most advantageous to the city. [3:01:59, 3:02:06]: Request for proposal number two thousand nineteen zero zero zero two three, general contractor for the amphitheater step two. [3:02:06, 3:02:08]: For construction of the amphitheater [3:02:08, 3:02:10]: For the amount of fourteen million. [3:02:11, 3:02:14]: six hundred sixty five dollars three hundred and sixty eight. [3:02:15, 3:02:17]: Plus the construction of the internal road and [3:02:19, 3:02:27]: For the amount of one million one hundred seventy two thousand four hundred and twelve dollars in a total not to exceed amount. [3:02:27, 3:02:35]: Of fifteen million eight hundred thirty seven seven hundred and eighty dollars and authorized the mayor to execute it to execute the same. [3:02:38, 3:02:41]: The award provides for the construction of the new amphitheater with the stage. [3:02:41, 3:02:43]: Accessory buildings and parking. [3:02:44, 3:02:52]: The RFP method of procurement was selected for the procurement to best serve the city with additional evaluation criteria other than price alone. [3:02:52, 3:02:55]: On September twelfth, twenty nineteen, the RFP [3:02:56, 3:03:01]: Opened to firms submit a proposed res submitted responses to the RFP. [3:03:02, 3:03:12]: H. J. Russell and Company and Hogan Construction Group LLC. On September nineteenth, twenty nineteen, a combination presentation and evaluation meeting was held. [3:03:12, 3:03:20]: After the presentation, evaluation, and scoring, the evaluation committee named HJ Russell and Company as the first rank firm. [3:03:20, 3:03:27]: City staff, cities consultant, TSW, and the attorney reviewed both proposals. [3:03:29, 3:03:29]: Yeah. [3:03:30, 3:03:36]: Ms. Moore, you have something you need to add? Only answer questions if you need. Okay, Miss Wiggins. Ms. Alexander. [3:03:37, 3:03:57]: Yes, I'd like to make a motion to accept the recommendation of staff to complete this transformational amphitheater project, uh making H.J. Russell the uh general contractor for this program. Okay, made motion is made and second. Any any questions? [3:03:56, 3:03:58]: Yes, real quick. [3:03:59, 3:04:13]: From our previous discussion, Miss Moore, I guess you can dis answer. From our previous discussion when we talked about how we was gonna about funding, these dynamics kinda changed and we uh we haven't really got into that discussion. [3:04:16, 3:04:36]: Actually I yeah, we we had um uh I did have some inf a conversation with our financial advisor about this. In fact I actually expected him to be here this evening regarding this. Uh y you may recall that uh there were several projects that the uh council was looking at, I think totaling just over thirty million dollars, I believe. [3:04:36, 3:04:53]: for uh several projects that could be financed uh through various ways. You remember of course that you approved or the legislature approved a public facilities authority that would enable us to help uh bond the projects. And so we also have SPLOST money. [3:04:53, 3:05:02]: About five million dollars in SPLOST money, and then the remainder then would be proposed to be financed via bonds, as we've had some previous discussions before. [3:05:04, 3:05:04]: Yeah. [3:05:05, 3:05:10]: Any further questions? Yes sir. Go right, Mr. Thomas. Any further questions this end? [3:05:12, 3:05:17]: Do I dare say this? All in favor please indicate [3:05:18, 3:05:20]: The downtown Nother has started. [3:05:22, 3:05:25]: All right. Yeah, good stuff. All right. [3:05:26, 3:05:31]: We are moving the city forward. On that note, city manager, do you have any comments? [3:05:32, 3:05:46]: No, you got one more, Mayor Uh six seventeen, that's right. Seventeen was added. That's right, Kira, Miss Braggs. Excitement is getting it. Ms. Braggs, you wanna talk to us about uh small Saturday, small south. I'm sorry about that. I I can't help it. [3:05:47, 3:05:48]: I'm I'm ready. I'm ready to [3:05:49, 3:05:51]: I'm ready to sit down in the audience and watch it. [3:05:51, 3:05:58]: Entertainment on an ampathyated interview. I was so excited about the ampathy about it. [3:05:59, 3:06:17]: Good evening, Mayor and Council. Good evening. Um the Stockbridge Main Street program staff um would like to ask your permission to host its Small Business Saturday Networking Social and Idea Smash at the Ted Strickland Community Center on Friday, November the first from six to eight PM. [3:06:18, 3:06:38]: Um this year, Small Business Saturday is going to be on November the 30th, and in preparation for this 10-year celebration, the Small Business Saturday Networking, Social, and Idea Smash will bring together past and potential small businesses that to participate in the Small Business Saturday. [3:06:38, 3:06:55]: Shop Small Movement and in addition, we will provide them with tutorials, suggestions for marketing and promotion promoting their businesses, and encourage networking between the different stock bridge businesses to maximize their benefit with regard to small business Saturday. [3:06:56, 3:06:57]: Mayor. Yes, ma'am. [3:06:57, 3:07:13]: I move I move that we approve the recommendation for November first to reserve for Tidd Strickland on um for the small business. Um second it in further discussion. If not, all in favor please indicate. [3:07:13, 3:07:15]: Fantastic. Thank you. [3:07:16, 3:07:36]: Mr. Knighton, any comments you have, sir? Um I would mention simply, uh, Mayor, obviously we have had a number of items that have come before you tonight where we the staff can be better, we should be better, we will be better. I do want to highlight uh two of the significant things that happened tonight with respect to the Jodico Design Guideline projects. [3:07:36, 3:07:55]: and also the Ampatheater Project. These projects have been talked about for years. Years. And it takes vision, leadership from the council. It also takes the staff working very hard to make these things happen. Uh the Jodico project took a lot of hours, a lot of time, a lot of work for a lot of people. [3:07:55, 3:08:00]: And um we were able to get there tonight. The amphitheatre. [3:08:00, 3:08:20]: Uh also took a lot of time, a lot of work, a lot of people, the staff trying to make sure that everything was in order on this project, being very meticulous about how we went about this, and it took a little more time that perhaps we wanted to, but we wanted to be sure we did it and we did it right and we brought you. [3:08:20, 3:08:40]: You something that you could be ready to approve and the citizens ultimately could be proud of. These are two transformational items that happen tonight that will change the face and look of Stockbridge for many, many years to come. [3:08:40, 3:08:42]: Good deal. Outstanding. [3:08:43, 3:08:45]: And you as you as elected officials. [3:08:45, 3:08:46]: I should be proud of the work. [3:08:47, 3:08:48]: That you have done. [3:08:48, 3:09:06]: And we appreciate the opportunity uh to work on these great projects and we look forward to them coming to fruition now and us um being able to conduct groundbreakings, celebrations and everything else that comes along with these type of projects. Thank you. [3:09:07, 3:09:10]: Thank you, sir. City Clerk. [3:09:10, 3:09:30]: Yes, Mayor and Council. Um congratulations to the City of Stockbridge, heads off to this council and staff um for a job well done. I also wanted to thank the clerk's office team for team building activities that we had over the last weekend where we were able to uh come together and bond over certain items and we almost [3:09:30, 3:09:31]: Almost [3:09:31, 3:09:43]: real close got out of uh the escape room and uh hats off also to uh our human resources manager who uh worked with us and helped us with those efforts. [3:09:44, 3:09:52]: Uh thank you. Uh Miss Clerk Vanessa. By the way, please use the a clock, the three minute clock, please. Mr. Thomas, go right ahead. [3:09:53, 3:10:06]: Um you know, I just wanna say in to the staff and to my councilmate and I think they know me pretty well. I'm I'm sorta even keel, but [3:10:06, 3:10:26]: When there's a spur under my collar, I tend to get a little upset. And uh I'm not apologizing for some of the things I said earlier, but I do want to just say that, you know, we have a great staff. Our staff does some great things, and maybe we don't we don't give them enough. [3:10:26, 3:10:46]: enough credit for a lot of the thing that they do to help move this city forward. And then when one thing goes wrong, you know, we want to beat'em up about it. So I I just wanna say, you know, we just have to take the good with the bad. But I I do feel great about our city, our staff. I think we are moving in [3:10:46, 3:11:06]: The right direction. And I think my staff ought to know me that I'm really big on the three Ps, policy, procedure, and protocol. And when those things are not met, I have a tendency to let staff know that. But just know that I appreciate that. [3:11:06, 3:11:17]: my staff. Y'all are doing a great job, but I just have a tendency when that one thing go wrong, um, I'm gonna lash out and uh and let it be known. Thank you. [3:11:18, 3:11:19]: Mr. Blount, please. [3:11:20, 3:11:40]: I wanna thank all the citizens that took time to stay here uh to this duration. Uh I just wanna echo something really quick, is that when I first came on as a s council member, uh a lot of the staff was nine to five. Um, a lot of them was nine to four twenty. But uh [3:11:40, 3:12:00]: But since I but but over time that we've been blessed, I think the city's really been blessed to have the the staff that is moving this city forward. I can't tell you how many times I've passed City Hall and and seen the assistant city manager car still sitting in the parking lot scares me to death because I'm like, hey you getting [3:12:00, 3:12:13]: not going and and the city manager and and the tireless work that I've seen so many do to in order to move this city forward. It's been it's it's elated to see that because at a time when I've seen where [3:12:14, 3:12:34]: We had to ask people to get things done. Now we're asking people slow down a little bit and let us know what you're doing. And that's a good feeling. So hats off for me to the staff. And I try to show everyone as much much as I can how much I appreciate you all. And I don't care if I spend all my time congratulating staff. You guys are awesome. You do a great job. [3:12:34, 3:12:54]: But I can pat my best self on the back. I'm the only council member here that's ever cooked everybody something to eat, right? So I can pat myself on the back for that. So but I'm just saying, uh staff, you guys do a great job. And and when I and I echo what Councilman Thomas says that when I when we sit up here and we see things out of whack that [3:12:54, 3:13:08]: that when it comes from you all to us, we shouldn't take it personal. When it comes from us to you all, don't take it personal because I think that we all have a heart for the city. We all have a heart of getting things done. And um my hats off to you all and that's all I'm gonna say. [3:13:10, 3:13:11]: Ms. Gantt, please. [3:13:12, 3:13:28]: Well, um, I don't have a lot to say. I I wanna thank you all for coming out tonight. Thank the citizens for being actively involved. And for the past six years, um a lot of the citizens from the outside looking in may not have [3:13:29, 3:13:49]: thought they saw a lot of improvements, but indeed there have been. There have been new hires. There's been an economic development director. We have a PIO officer. We have new positions and we have new things coming. We first came in, we didn't know what our balance was. And here we are finally about to break ground on the amphitheater that [3:13:49, 3:14:04]: We've talked so much about and it's exciting. I think the whole council right now is just on 10 and and we're excited. And next year, this time, we've already planned and started planning for the art center. And so we've saw renderings and they are absolutely [3:14:05, 3:14:25]: beautiful and outstanding. We think you're gonna love them. And next year this time we'll be probably breaking ground on that. So we're moving right along and I love the way the puzzle fits. Um I just want to thank staff for their hard work and dedication on that and for having to deal with council members who have the pressure of the [3:14:25, 3:14:40]: citizens, um that's a heavy load to to carry and and I recognize that. So thank you. I also want to give a shout out to our clerk who received her master's in clerk [3:14:40, 3:14:44]: Education, is that correct? Um [3:14:49, 3:15:06]: W um staff has done phenomenal work here and they continue to do phenomenal work. Um I want to even from permitting, let's just let's give a shout out to Ms. Morphe. She's brought permitting in within a short time frame right here in Stockbridge. [3:15:08, 3:15:28]: And on top of that, because we had delays and delays and delays trying to get per meetings done through our fire marshals and different things, guess what we did? We hired a fire marshal. So I just wanna say thank you guys for everything and everything you're continuing to do. Citizens, keep us in your prayers. This is not an easy job. [3:15:28, 3:15:38]: We have to weigh the good and bad and the best thing we can do is keep stop do what my decisions are what what I believe are in the best interest of stop read. So thank you. [3:15:40, 3:15:42]: Yeah, sorry, Mr. Alexander, please. [3:15:42, 3:16:02]: Uh thank everybody for tuning in. Somebody reminded me the other night they don't come to the meetings. Doesn't mean they're not watching. So I know you're watching now. And we do our very best to move things forward in the city. I want to echo echo the sick city manager's comments that these are transformational historically. [3:16:02, 3:16:22]: Historic projects. Tonight we'll go down in the history of Stockbridge as one of the greatest nights in the city history because there were decisive actions and strikes for our future that will dictate and that will last and that will stand the test of time. This council started. [3:16:22, 3:16:33]: By hiring our city manager, who is the former county manager for Hall County, we brought an exceptional leader here to lead the city. [3:16:34, 3:16:54]: We made sure that we compensated him properly and that we compensated all of the staff because we re-evaluated what their pay scale was to make sure that we could compete for the top talent in Metro Atlanta, and now we have it. It's no accident that we're moving forward and that the city is on some. [3:16:53, 3:17:13]: Solid footing. No matter what happens in the upcoming elections, the city is in good shape. The foundation has been set. We completed the first comprehensive, the city-only comprehensive plan in city history. It dictates what our path will be like until 2038. We hired a fire marshal. [3:17:13, 3:17:33]: To get with our planning and zoning inspections because it wasn't good enough to have the zoning part done and then have to wait. So we hired a fire marshal. We hired a fire marshal to take care to make sure that those safety needs were being met and that we could make sure. No, we did not. We did not have to have a [3:17:33, 3:17:53]: fire department in order to do that. We had a someone who was certified as a fire professional at the top level to be able to execute and operate at a high level. And we want to make sure that everything we do for the city is indeed, you know, we landed uh in addition to that, we just landed the first [3:17:53, 3:18:06]: International corporation to ever call Stockbridge home, the Hegler Corporation. It's been an outstanding year for the city. We have make sure that we focus on beautification for the city. [3:18:06, 3:18:26]: All of the above and today uh we had we just started early voting. So make sure you get out and vote. No matter who you vote for, Startbridge is gonna be in good shape. We have a solid foundation and we need you to support the community to make sure that we keep moving forward because we're gonna be the shining star when you see it look at it. [3:18:26, 3:18:28]: At South Metro. Thank you. [3:18:29, 3:18:49]: Ms. Robinson, please. Thank you, Mayor. Um again, I just want to echo what my colleagues said to staff. You guys are doing an outstanding job. Um again, we how fitting tonight. This um we've waited a long time to get here. Um like I said, 2016, it feels like a lifetime. Um, but we finally met. [3:18:49, 3:19:09]: made it. We've gone through a lot of ups and downs, um, you know, even in our community. But I just want to say um to our citizens, thank you for so much for continuing to be engaged. Um you come, you would do your comments, and we listen. It helps us to be better leaders and we thank you for that. Um but I do [3:19:09, 3:19:20]: wanna acknowledge that our state senator, Senator Emmanuel Jones, has been with us here tonight um through our entire process. So we just wanna be glad that he's here. [3:19:21, 3:19:41]: And we just had a successful hometown connection. And our hometown connection, it actually is where we had hosted by the city of Stockbridge, we had our state legislators, um, we had our um county and city officials all in one room. And basically we were able to discuss our achievements. [3:19:41, 3:20:01]: And our challenges to our um delegation. Um our senator was there, and I tell you it was outstanding and and so fitting for tonight, for our senator, our senator, because he is our senator, to be present tonight once we approve this and got to hear a lot of things that we're going. [3:20:01, 3:20:21]: you know, that's happening in our city. So it's a great day. Um so to each citizen staff and hopefully Senator Jones, you'll be able to um take that back. Um so that way you'll know that Stockbridge is moving forward. Um we're progressive and we're on the move. And to all the businesses, just know we're open for business. So come [3:20:21, 3:20:25]: um grow with us here in Stockbridge. So thank you so much. [3:20:26, 3:20:32]: All right. And uh for my comments I would tell you, uh I'm very excited the fact that we were moving forward. [3:20:32, 3:20:39]: We approved the design guidelines for Jill Couth or every property, whatever you want to call it. It's the most southern part of Stockbridge. [3:20:39, 3:20:45]: And we have uh we're gonna develop that and you citizens are gonna be very proud of that development. [3:20:45, 3:20:46]: What goes down there? [3:20:46, 3:21:06]: The fact that you won't have to worry about going, I was going down to downtown or buckhead or wherever you want to go. I mean, you can stay right here in Henry County, in Stockbridge, and enjoy yourself. It's coming. We just proved that tonight. Amphitheater's gonna hit first, though, and have to be the anchor for our downtown redevelopment, because that's gonna happen as well. And I want you to know that uh [3:21:06, 3:21:26]: As we go through this process, I just I want you to pray with me, you know, not right now, but in your own prayer, that this that the fact that the amphitheater would be done, completed, hopefully, by August 6th of 2020. That is our 100th year anniversary. That's the actual date that we turn 100 years old. And wouldn't that just be just picture that? [3:21:26, 3:21:34]: New amphitheater, off-the-chain party celebration, and we celebrate a hundred years. And we're and the census is next year, and we're growing. [3:21:34, 3:21:54]: And the South Metro area is gonna be hopping. Where in Henry County? Where in Henry County? Stark Bridge, Georgia. I mean, just imagine that. And you live here, you're gonna work here, you're gonna play here. I tell you what, it's go, hey, we're gonna have a good time. And we're gonna do the right thing. So we continue to keep the faith with us, all right? Continue to keep the faith because we're we're we're we're live. [3:21:54, 3:22:02]: Listening to you. We're gonna move forward and uh we're gonna make you proud, and you're gonna be proud of the fact that you live in this community. [3:22:03, 3:22:03]: All right. [3:22:04, 3:22:06]: And may God continue to be with us all. [3:22:07, 3:22:09]: On that note, let me read some announcements here. [3:22:10, 3:22:14]: New council meeting is Wednesday, October sixteenth, five thirty in the council chamber.
