[0:00:17, 0:00:24]: So that whatever we say and whatever we do will be in the best interests of the citizens of the city of Stockbridge. [0:00:24, 0:00:26]: This we pray in Jesus' name. [0:00:26, 0:00:27]: Amen. [0:00:27, 0:00:29]: Amen. [0:00:30, 0:00:31]: Pledge of allegiance. [0:00:37, 0:00:49]: All right, a pledge allegiance to the United States of America, to the Republic, which is fan, one nation, one nation, under God, indivisible, with liberty with liberties, that's his fault. [0:00:51, 0:00:54]: All right. Linda, would you call a rope? [0:00:54, 0:00:57]: Yes. [0:00:57, 0:00:58]: Present. [0:00:58, 0:00:59]: Maybe we do us. [0:00:59, 0:01:00]: Present [0:01:01, 0:01:02]: Kathleen Nelson? [0:01:02, 0:01:03]: Is it? [0:01:03, 0:01:04]: Jeroughly Wallace. [0:01:05, 0:01:05]: Present. [0:01:06, 0:01:07]: Uh, the buttons. [0:01:19, 0:01:20]: I have a motion to uh [0:01:22, 0:01:23]: To adopt the agenda. [0:01:25, 0:01:32]: I will motion to adjust adopt the agenda for December the seventeenth, twenty twenty at six thirty. [0:01:33, 0:01:34]: I will second that. [0:01:35, 0:01:38]: All in favor that you know by sign of I [0:01:38, 0:01:41]: Uh those opposed? [0:01:44, 0:01:46]: Hearing non um [0:01:47, 0:01:48]: The motion is carried, uh [0:01:49, 0:01:51]: Sorry, who made a motion and who seconded? [0:01:52, 0:01:53]: Um [0:01:54, 0:01:55]: I'm not sure. [0:01:56, 0:01:56]: Surely. [0:01:57, 0:01:59]: And I think Clinton, you didn't use second? [0:02:00, 0:02:01]: Mr. [0:02:01, 0:02:02]: Yeah. [0:02:02, 0:02:07]: Mr. Planton. Plant has been moved and second. All those in favor, let it be known by the sign of I. [0:02:07, 0:02:10]: Aye aye. Those opposed. The ayes have the motion is carried. [0:02:12, 0:02:16]: Uh I'm gonna review the minutes from the November nineteenth uh meeting. [0:02:26, 0:02:29]: Are there any noted changes or amendments? [0:02:31, 0:02:38]: Unless anybody would like to hear the minutes, I would like to make a motion that we accept them as written. [0:02:39, 0:02:41]: I'll second that motion. [0:02:42, 0:02:49]: It's been moved and seconded that the uh minutes be approved from the November nineteenth meeting. All those in favor, let it be known by the sign of aye. [0:02:49, 0:02:51]: Uh I propose. [0:02:53, 0:02:54]: It's been moved in second. [0:02:54, 0:02:56]: The motion is carried. [0:02:57, 0:02:58]: Ну бізнес. [0:03:02, 0:03:07]: Number one is recombination case RC twenty twenty oh three. [0:03:08, 0:03:09]: Ms. Logan? [0:03:10, 0:03:14]: Yes, I'll read for the record the uh description of the case. [0:03:14, 0:03:34]: Neil Colbull requests a recombination of five contiguous parcels, as are listed below, into one parcel, creating a new plat. The parcels are located within landlot 29 of District 7 within the city of Stockbridge, within the Stockbridge city limits, along Brandon Road and North Salem Drive. All five parcels. [0:03:34, 0:03:40]: Currently have the same zoning classification, RA, which is residential agricultural. [0:03:40, 0:03:44]: This allows a proposed recombination to be considered. [0:03:44, 0:03:48]: So these are the five parcels. Seven thirty two Brandon Road. [0:03:49, 0:03:53]: Parcel number O eight eight O two O four nine thousand. [0:03:53, 0:03:54]: Um [0:03:55, 0:04:02]: Parcel at six six four Brandon Road, parcel number O eight eight O two O five zero zero zero zero. [0:04:03, 0:04:10]: And six one eight Brandon Road, parcel number zero eight eight zero two zero five one thousand. [0:04:11, 0:04:29]: Then a large parcel on Brandon Road with no address, parcel number 088-0204-9005. And finally a small parcel on North Salem Drive with no address, parcel number zero eight eight zero two zero four five thousand. [0:04:33, 0:04:34]: Okay. [0:04:36, 0:04:45]: Anything else on that did uh what staffing say about this recomment? I have a presentation and I am trying to share my screen. [0:04:45, 0:04:45]: Okay. [0:04:46, 0:04:48]: Click on the screen, uh [0:04:48, 0:04:51]: Share screen button but it says host disabled. [0:04:51, 0:04:53]: Participant screen sharing, Robert. [0:04:54, 0:04:55]: I'm sorry. [0:04:57, 0:04:57]: Can we just [0:05:05, 0:05:07]: Okay, here we go. Let's see. [0:05:11, 0:05:12]: All right. [0:05:13, 0:05:15]: All right, here we go. Can everyone see my screen? [0:05:17, 0:05:19]: Yes. Yeah. Oh I heard. [0:05:19, 0:05:22]: So here is the the the cover page. [0:05:23, 0:05:23]: Um [0:05:24, 0:05:26]: Just describing uh what this case is about. [0:05:29, 0:05:41]: All right, so the next slide, this is a city's zoning map. The purpose of showing you this is just to show the location of the property. Um, it's very tiny, but uh this yellow area here. [0:05:42, 0:05:50]: Is at the very eastern edge of the city and ha has some enlargements, but this just gives you a general orientation of where it is. [0:05:50, 0:05:57]: Okay, my next slide. This is a close up again. It's this yellow parcel here, yellow tracked here. [0:05:59, 0:05:59]: Um [0:06:01, 0:06:02]: Okay. [0:06:02, 0:06:19]: Then we have an aerial photo of the vicinity and you see Brandon Road going here, north to south, North Salem Drive here. And this is one address of 732 Brandon Road. The rest of the property is in this area. It's mostly vacant. [0:06:20, 0:06:22]: Uh there are a few houses there. [0:06:23, 0:06:27]: Uh this is actu that's another enlargement of the track. [0:06:28, 0:06:34]: And then we have um this shows the surrounding neighborhood, another aerial photo. [0:06:36, 0:06:45]: And this shows more where the five parcels are located. You have the largest one in the center. This one here is 732 Brandon Road. [0:06:45, 0:06:46]: And uh [0:06:47, 0:06:50]: Six six four and six one eight. [0:06:50, 0:06:52]: Down here and then up here is a one on [0:06:53, 0:06:54]: North Salem Drive. [0:06:58, 0:06:59]: And yet another [0:06:59, 0:07:05]: Just these are these are aerial photographs from the Henry County Tax Assessor's Office. [0:07:06, 0:07:08]: All right. This is a um [0:07:08, 0:07:11]: The site survey that the applicant provided. [0:07:11, 0:07:15]: shows you a little more clearly the boundaries of the five parcels. [0:07:17, 0:07:35]: All right, project information. So the request is to combine five existing parcels into one parcel to allow for the creation of development site for proposed subdivision. I've listed again here the five parcels that I just ran into the record. Again, the applicant is Neil Coble. [0:07:35, 0:07:40]: Properties on the east side of Brannon Road and south side of North Salem Drive. [0:07:40, 0:07:49]: Existing uses are rural residential, minor minor agriculture uses, a cell tower at 732 Brandon Road, and some vacant land. [0:07:50, 0:07:55]: The current zoning is RA, which is residential agricultural for all five parcels. [0:07:56, 0:08:01]: And the proposed project is development of a subdivision with 147 lots and 147 homes. [0:08:04, 0:08:08]: The applicant has submitted a proposed site plan. [0:08:09, 0:08:23]: I'm not going to go into detail on that right now. Uh when we get to our next case for the actual rezoning, that's when we can discuss that in detail. This this right now is just giving you a general idea of what it's going to look like. We have Brandon Road here on the left. [0:08:23, 0:08:26]: And uh North Salem Drive actually goes [0:08:26, 0:08:27]: Up through here. [0:08:28, 0:08:34]: So the entrance would be here off north off of Brant Brannon Road. It's directly across from um [0:08:35, 0:08:46]: the Clark Meadows subdivision entrance. So this just gives you a general idea. There is a pond down here in this corner corner and some open space floodplain areas in the center. [0:08:48, 0:08:49]: Okay. [0:08:50, 0:09:00]: So we have a few conclusions. The existing five parcels currently all have the same RA zone and classification, thereby allowing the proposed recombination to proceed. [0:09:01, 0:09:04]: Conclusion number two, the property will need to be rezoned. [0:09:04, 0:09:05]: Uh [0:09:06, 0:09:07]: after recombination is approved. [0:09:08, 0:09:15]: Uh conclusion number three, applicant will need to take several steps after proposed recombination is approved as follows. [0:09:15, 0:09:17]: If if he wants to proceed with [0:09:18, 0:09:21]: Is uh pro developing his proposed subdivision. [0:09:21, 0:09:23]: rezone the property from existing RA [0:09:24, 0:09:28]: to R three if the current site plan is to be used. [0:09:28, 0:09:34]: Obtain approval of technical merits of proposed subdivision from city staff. That's number two. [0:09:34, 0:09:37]: Number three, submit a subdivision application. [0:09:37, 0:09:42]: to the planning commission for approval after the property is rezoned. Of course that will come later. [0:09:43, 0:09:43]: Um [0:09:44, 0:09:50]: Officially record number four, the new subdivision plaque with Henry County Superior Court Real Estate Division. [0:09:50, 0:09:57]: And number five, apply for land disturbance permits and building permits with the city. Recommendation is approval. [0:09:58, 0:10:02]: If the applicant wishes this approval this approval can be made contingent. [0:10:02, 0:10:09]: upon the companion rezoning case RZE twenty twenty oh two which is on next on our agenda. [0:10:09, 0:10:12]: being approved by the mayor and city council. [0:10:12, 0:10:14]: That's all I have for this case. [0:10:18, 0:10:19]: Any questions? [0:10:27, 0:10:28]: Any questions on recombination? [0:10:30, 0:10:33]: Is the uh applicant present? [0:10:34, 0:10:35]: I'm here, Mr. Chairman. [0:10:36, 0:10:36]: Yeah. [0:10:37, 0:10:44]: Uh I I've looked at this recombination and uh and while this my question I have may not apply right now. [0:10:45, 0:10:47]: But it most certainly has an impact on this. [0:10:47, 0:10:52]: I'm concerned about the infrastructure, the sewer, the water availability, et cetera. [0:10:52, 0:10:58]: Um that's not uh uh that's not available right now. In fact, it's just that um [0:10:59, 0:11:04]: Uh the current infrastructure system will not support that. How do you plan to address that? [0:11:06, 0:11:16]: I would like to uh ask that Steve Moore, the engineer that I've hired to uh work on these utilities, if you could unmute him, he'd he can address that. [0:11:18, 0:11:20]: Great. [0:11:20, 0:11:21]: Pardon me? [0:11:21, 0:11:23]: Excellent to stop sharing her screen. [0:11:24, 0:11:25]: Linda. [0:11:25, 0:11:28]: Oh yes. Uh made a stop sharing my screen. [0:11:28, 0:11:33]: Yeah. Okay. Let's see. I'm not sure how to do that. [0:11:33, 0:11:35]: Uh two okay. [0:11:36, 0:11:39]: Oh, he did it for me. Yeah, Linda did that. Yeah. [0:11:41, 0:11:46]: Good evening. My name is Steve Moore. I'm with Moor Bass Consulting. We're at thirteen fifty Keys Ferry Court in McDonough, Georgia. [0:11:46, 0:11:49]: Uh we're a civil engineering and surveying company. Um [0:11:50, 0:11:52]: Our role in this project is [0:11:52, 0:11:53]: Uh [0:11:53, 0:11:55]: I guess based on this current agenda item. [0:11:55, 0:11:57]: Is prepare the survey to combine [0:11:58, 0:12:04]: the five parcels into one, which is a prerequisite requirement to the actual zoning application, since they all have to be [0:12:04, 0:12:05]: One parcel. [0:12:06, 0:12:10]: Um and I I know that you have questions about the subsequent item on the agenda. [0:12:10, 0:12:13]: And we do have a presentation we're prepared to uh [0:12:13, 0:12:17]: display that describes uh those items uh [0:12:17, 0:12:19]: As it relates though. [0:12:19, 0:12:20]: Just quickly to water and sewer. [0:12:21, 0:12:24]: Um there is a water or sewer extension. [0:12:24, 0:12:28]: That is uh proposed along with this project that extends. [0:12:29, 0:12:31]: Северо тазен фіт осерфі. [0:12:32, 0:12:33]: uh to the property. [0:12:33, 0:12:36]: That provides uh public sewer. [0:12:36, 0:12:43]: Uh we have uh confirmation from the water authority, the Henry County Water Authority that with that extension there will be adequate uh [0:12:43, 0:12:46]: uh utilities available to the site. [0:12:46, 0:12:47]: Um but again that is [0:12:47, 0:12:48]: really part of the. [0:12:49, 0:12:51]: Next item on the agenda, which is the rezoning request. [0:12:52, 0:12:52]: Um [0:12:53, 0:13:00]: related to this current item, uh again, the purpose is to just to combine these tracks into one track that will be subject to [0:13:00, 0:13:03]: This subsequent rezoning uh item that's on your agenda. [0:13:04, 0:13:04]: Um [0:13:05, 0:13:06]: We've surveyed [0:13:06, 0:13:10]: The entire property uh all of the uh five tracks. [0:13:10, 0:13:14]: And have supplied the city with a a plat that shows. [0:13:14, 0:13:17]: how those tracks would be combined into one. [0:13:17, 0:13:19]: Once uh if you choose to approve it. [0:13:20, 0:13:20]: Uh we will [0:13:21, 0:13:28]: Process that and submit to the Henry County Tax Assessors Office for reassignment of tax parcel ID numbers, which will be then [0:13:29, 0:13:32]: applied to the rezoning as it makes it to the city council. [0:13:32, 0:13:33]: Um but [0:13:33, 0:13:35]: Again, related to this specific [0:13:35, 0:13:37]: uh agenda item that's our proposal. [0:13:38, 0:13:41]: I'm happy to answer any questions you have related to that item. [0:13:41, 0:13:42]: At this time. [0:13:43, 0:13:47]: My my reason for asking that question now is that um [0:13:48, 0:13:49]: Um [0:13:50, 0:13:58]: You're talking about bringing in first of all, the recombination would wouldn't wouldn't work if you didn't have the uh zoning, correct? [0:14:00, 0:14:03]: They wouldn't be required unless we were asking for zoning. [0:14:04, 0:14:06]: Right. Um and so yes, sir. [0:14:06, 0:14:07]: My interest is this. [0:14:07, 0:14:10]: Is that there's an issue with the infrastructure? [0:14:10, 0:14:12]: There's an issue with uh traffic. [0:14:14, 0:14:22]: And uh the density uh that's going to be increasing that area and uh. [0:14:27, 0:14:34]: The fact that you gotta requ you you got to acquire easements to do all this, et cetera. My thing is this. [0:14:34, 0:14:38]: Is that I'm I'm I'm thinking about the adjacent property owners. [0:14:38, 0:14:41]: who um have opposed this [0:14:41, 0:14:46]: You know, I mean they got legitimate concerns with it. Some of'em have been there thirty years plus. [0:14:47, 0:14:48]: Um [0:14:48, 0:14:53]: This is going to increase the traffic. They brought the issue about that uh Hickory Flat school. [0:14:54, 0:14:56]: uh the traffic conditions, et cetera. [0:14:56, 0:15:05]: And I would think that I would want to address all of those issues before I even got to the recombination because that would make the recombination and the rezoning easy. [0:15:08, 0:15:11]: If those are have have have been addressed already. [0:15:11, 0:15:19]: And uh that's my concern for asking it right now. Not I'm positioned one way or the other. I just wanted to get an answer for that now. [0:15:20, 0:15:40]: Yeah, so the answer, sir, is that we have addressed those. Um and I think what we're just following the city's process, which is they uh city has requested us to uh re uh to combine these parcels. Um so if you would like to hear the um [0:15:40, 0:15:47]: I saw Linda made this um subject uh to the possible rezoning case that you're about to hear next. [0:15:47, 0:15:52]: Which is where we've prepared uh with the full diligence. [0:15:52, 0:15:55]: The utilities and traffic and [0:15:55, 0:16:05]: We've had uh community meetings. Um so this uh agenda item that you're hearing now is just part of the city's [0:16:06, 0:16:12]: um the scre d direction. I understand that's the initial step and I and I I'm I'm not opposed to that. [0:16:12, 0:16:17]: I just wanted to get that out of the way before we even got to the zone. That was an interest that I had personally. [0:16:18, 0:16:21]: Not just had anything that I was just interested in some questions that I needed answered. [0:16:22, 0:16:23]: Uh [0:16:25, 0:16:26]: Any other questions? [0:16:27, 0:16:29]: Yes, this is Dave Planchon. [0:16:30, 0:16:35]: I see there are five five parcels in this area that's proposed development. [0:16:36, 0:16:39]: Are they currently owned by five separate property owners? [0:16:41, 0:16:48]: And if so, do we have an agreement that all those property owners are actually a part of this development? [0:16:50, 0:16:59]: It's uh it's one family uh that owns this farm. Uh so it's owned in as a family farm uh investment. [0:16:59, 0:17:01]: So it's all all under one property. [0:17:03, 0:17:05]: Okay, so it's currently really under one ownership. [0:17:06, 0:17:09]: All the properties. Yes, yes. Okay. Thank you. [0:17:13, 0:17:14]: Any other questions? [0:17:15, 0:17:33]: I I do. I I have uh a a concern uh about combining them, uh being that there's been so much interest in this property, especially from Councilman Elton Alexander, um, reaching out to board members on separate occasions in support of this project. Um [0:17:33, 0:17:34]: In um [0:17:35, 0:17:37]: To be fair. [0:17:37, 0:17:38]: You know [0:17:38, 0:17:45]: I feel and other board members feel that it was inappropriate that Elton Alexander has been um [0:17:45, 0:17:46]: Pretty much. [0:17:47, 0:17:50]: presenting himself as though he's working for [0:17:50, 0:17:52]: The applicant and not the city. [0:17:53, 0:17:57]: And that leaves a bad stain for me, especially for me. [0:17:58, 0:18:03]: Um, in conversations that I personally have had with uh Councilman Alexander. [0:18:03, 0:18:04]: So [0:18:04, 0:18:07]: In in saying so, um [0:18:07, 0:18:16]: His his opinions does not weigh in on any opinion that I would give or thought that I would have toward this property. I want I want to make that clear. [0:18:16, 0:18:20]: And that's a matter that has to be taken up in another form, but [0:18:20, 0:18:33]: With these properties, um, have you all even reached out to the community at all to try to gauge the community to see how receptive they would be of having? [0:18:34, 0:18:36]: Such a large um [0:18:36, 0:18:43]: A n a new residential area so close and such a tight space as it is already. [0:18:46, 0:19:06]: My name is Michelle Battle with Battle Law, and I'm the legal counsel for the applicant. Because we were only dealing with the preliminary, well, sorry, with the lot combination, I didn't chime in, but I wanted to make a couple of clarifying statements. Number one, with regards to the plat um lock combination. [0:19:06, 0:19:07]: combo. Um [0:19:09, 0:19:29]: Any property owner certainly that owns multiple parcels that are contiguous to each other have the right to seek a uh combination of those parcels into one tax parcel in order to spare them from having multiple tax bills. Um in this instance, this um particular lot combo. [0:19:28, 0:19:48]: Was being precipitated by the desire to rezone the property. So I think that it is absolutely um appropriate for um whether or not this combo goes through to be uh connected into the proposed rezoning. Um we are more than happy to move into the discussion with regards to. [0:19:48, 0:20:08]: The rezoning. That seems to be the crux of the issue here. And so if you would like for us to do our presentation with regards to that, we can certainly start that now. We don't want to be duplicitous in our presentation, which is why I had not entered into this at this point. [0:20:08, 0:20:28]: Seems like that's really what you guys want to talk about in conjunction with this lot combo. So if you would like, um I'd be happy to move forward with our presentation. But I believe that Ms. Logan has the presentation materials um that she would have to display and go through her presentation so that we can then [0:20:28, 0:20:36]: um follow up with the things that we wanted to point out with regards to the proposed rezoning and the lock combo. [0:20:36, 0:20:56]: No, we're gonna follow the process that we have already in place and we're not gonna jump ahead. The questions are there. We're gonna follow the procedures that this board normally follows, especially in hearing that you know, more than likely there's other questions that this board, but the board members are gonna have. [0:20:56, 0:21:02]: And there's gonna be a lot of concerns here, especially from the board and also from the citizens as well. [0:21:03, 0:21:04]: So um [0:21:04, 0:21:24]: So the lot, the lot, the lot combo itself again is being requested from two perspective perspectives. Number one, there is one property owner that owns all of this land. And as a property owner that owns property that is contiguous to each other, um, they have a right to seek to combine all [0:21:24, 0:21:44]: all of that into one lot. The intent here is simply to create one large lot as opposed to having the five individual lots. With that said, I don't know that there's really too much more for us to contribute other than we have addressed the issue. [0:21:44, 0:22:04]: We will be bringing sewer into this project. And so the sewer utilities will be addressed in a part of the proposed rezoning. And we do have access to the other utilities that we will be providing as well on site. So I know that was one of the questions. [0:22:04, 0:22:13]: questions that had been previously raised. I'm not sure what else we can contribute that doesn't bleed over into the zoning component of this. [0:22:13, 0:22:23]: Well one statement you made is that the right uh the lot only has a right to uh combine these lots that are contagious. To seek to find to seek to combine them. [0:22:23, 0:22:25]: Uh does Mr. Cobel own those lots? [0:22:27, 0:22:37]: Um he is acting on behalf of the owner and the owner gave him the authority to um proceed to seek the combination. So he is in that sense representing the owner. Okay. [0:22:38, 0:22:42]: Mr. Chairman. And and this is Dave again. They could they could have requested [0:22:43, 0:22:48]: the common uh combining these lots even before there were plans to develop it. [0:22:49, 0:22:57]: Correct. I don't think that would have the development part of it wouldn't even enter into this question about combining those lots. They they could have done that years ago. [0:22:58, 0:23:04]: You know, until somebody was ready to develop it and then come to us with the development proposal. So [0:23:04, 0:23:07]: I think we gotta they're probably two separate issues. [0:23:11, 0:23:12]: Mr. Chairman. [0:23:12, 0:23:13]: Все [0:23:13, 0:23:18]: Uh Stan Doom is here and I apologize for my camera not working tonight. [0:23:20, 0:23:40]: But if I may uh suggest that we because what I've heard just heard is correct, the property owner is common to all five parcels and the zoning is common to all five parcels at this point. [0:23:40, 0:23:44]: So I would recommend that we take a vote on the recombination. [0:23:45, 0:23:58]: uh and then move to the next item on the agenda and where we can adjust at that point address the concerns that people may have regarding whatever issues they may have. [0:23:58, 0:24:03]: with respect to developing a subdivision. But as far as combining the parcels, [0:24:03, 0:24:08]: On this particular item, I think we need to vote on it and then move forward. [0:24:08, 0:24:12]: Are you making a motion, Mr. Dumas? I certainly am. I move approval. [0:24:13, 0:24:16]: I will second the approval to combine the parcels. [0:24:16, 0:24:20]: It's been moved and second. All those in favors, let it be known by the sign of aye. [0:24:21, 0:24:23]: Aye. Aye. Those opposed? [0:24:24, 0:24:30]: It's been moved and seconded. I asked have the motion carries. The uh recombination uh is approved. [0:24:34, 0:24:34]: Linda? [0:24:35, 0:24:36]: Okay. [0:24:44, 0:24:47]: Okay, so the next next item on the agenda [0:24:48, 0:25:08]: Number two, rezoning case number R Z 2020. This was deferred from the November 19, 2020 meeting. Neil Coble requests the rezoning of certain property from RA Residential Agricultural District to R three single family residential district to allow for the development of a single family residential district. [0:25:07, 0:25:09]: [1509.6, 1524.6]: The property is located in landlot 29 of District 7 within the Stockbridge city limits along the southeast corner of Brandon Road and North Salem Drive. It contains 73.71 total acres within five parcels as follows. [0:25:25, 0:25:30]: Again, seven thirty-two Brandon Road, parcel number O eight, eight, O two, O four, nine thousand. [0:25:31, 0:25:36]: Six six four Brandon Road, parcel number O eight, eight, O two, O five, zero zero zero zero. [0:25:37, 0:25:38]: Six one eight Brandon Road. [0:25:39, 0:25:42]: Parcel number O eight eight O two O five one thousand. [0:25:43, 0:25:55]: A large parcel on Brannon Road, parcel number 088-0204-9005, and a small parcel on North Salem Drive, parcel number 088-0204-5000. [0:25:56, 0:26:04]: So I have a presentation for that as well, this case. And if I could let's see. [0:26:05, 0:26:07]: Share my screen again. [0:26:12, 0:26:13]: Trying to bring it up. [0:26:14, 0:26:16]: Okay, share. [0:26:18, 0:26:19]: That's not the right one. [0:26:23, 0:26:25]: Let's see. [0:26:25, 0:26:29]: Don't see it now. Robert, I need your assistance. [0:26:31, 0:26:32]: Robert, are you there? [0:26:34, 0:26:40]: Yes, ma'am. Do you see the share button at the bottom? Share screen button? I did and I clicked on it, but I don't know what happened. [0:26:41, 0:26:42]: It's not even there anymore. [0:26:43, 0:26:44]: Went away. [0:26:44, 0:26:47]: It says I'm now screen screen sharing. [0:26:47, 0:26:49]: But yeah, your entire screen. [0:26:50, 0:26:52]: But my presentation is not shown. [0:26:54, 0:26:55]: Hit the share screen button at the bottom. [0:26:56, 0:26:57]: Okay, here it here it came back. [0:26:58, 0:26:59]: Got [0:26:59, 0:27:01]: Okay. I'm tired again. [0:27:01, 0:27:03]: I don't see my presentation though. [0:27:07, 0:27:12]: Or just pull it up from the bottom. It's here at the bottom. That's it right there. Can anyone see that? [0:27:13, 0:27:16]: Uh you still have to share it. So click the share screen button again. [0:27:17, 0:27:18]: Okay. [0:27:20, 0:27:22]: I clicked it, but then the presentation went away. [0:27:25, 0:27:28]: Yep, so you're showing your desktop. So when you open share screen. [0:27:29, 0:27:32]: It defaults to your desktop, we need to um change that. [0:27:34, 0:27:40]: But since we see your desktop, do you see that at the bottom, can you just open up the PowerPoint presentation that you wanted to share? [0:27:41, 0:27:42]: It's right here. [0:27:42, 0:27:43]: Okay. [0:27:43, 0:27:46]: You can see that. Is that with the green is that with the green titles? [0:27:46, 0:27:50]: With the green titles, that's correct. Everyone can see that everyone can see that? [0:27:51, 0:27:58]: Yes. Yes. Okay. Very good. So this is the cover page again describing the case. Um [0:27:59, 0:28:05]: I have this the same map. Some of these slides in here are the same as what I had for the recombination case. [0:28:05, 0:28:13]: So I'll just quickly uh click through them. You can see them again. And uh I have a lot more slides though. [0:28:23, 0:28:43]: Okay, the applicant Neil Koble is from Liberty Communities LLC. The agent is Moorbass Consulting. Uh the request is to rezone five parcels of land from RA Residential Agricultural to R3 single family residential after they've been combined via the approval of RC two oh two oh three, which we just did. [0:28:43, 0:28:46]: To allow for the creation of a development site for proposed subdivision. [0:28:46, 0:28:48]: I've listed the parcels again. [0:28:49, 0:29:09]: I have information here about the sign postings, uh uh legal requirement to post signs on the property. We actually have posted signs in in three locations. We have one on uh North Salem Drive, North Salem Drive, and two on Brann Road. They were first posted on October twenty-sixth. [0:29:09, 0:29:10]: That was at a time when [0:29:10, 0:29:12]: We were going to have [0:29:12, 0:29:16]: this case heard at the November nineteenth meeting, then when we change when the [0:29:17, 0:29:18]: case was deferred to tonight. [0:29:19, 0:29:29]: Then we had some overlay strips. We went back out there and um posted the strips. We had to order some more on on those these two dates, November 16 and 23. [0:29:30, 0:29:32]: I'm just providing this information for the record. [0:29:34, 0:29:45]: Okay, properties at the east side of Brandon Road, south side of North Salem Drive, its surrounding land uses include rural residential, minor minor agricultural, several subdivisions, and vacant land. [0:29:45, 0:29:55]: Um two subdivisions are located across from the subject property on the west side of Brandon Road, Clark Meadows Subdivision and Mount Moss Point subdivision. [0:29:56, 0:30:07]: Surrounding zoning, uh, we have Clark Meadows, a zone PD that includes parts of it are R2 and R3. Plan development, that's um previous. [0:30:07, 0:30:11]: zoning classification that was used some years ago. [0:30:11, 0:30:29]: Moss Point Zone R2. Um, I will point out that we looked at the um subdivision plats for both of those subdivisions to actually see what size of lots they had and uh discovered that the lots which have frontage on Brandon Road. [0:30:29, 0:30:33]: were around fif at least fifteen thousand uh square feet. [0:30:34, 0:30:44]: The future land use designation is low density residential. This allows a density of 1.25 to two dwelling units per acre. [0:30:45, 0:30:46]: Soning history. [0:30:46, 0:30:59]: We did not find any previous rezoning cases. Uh the property at 732 Brandon Road was annexed into the city in 2004 and it had existing cell tower. It was there at that time. [0:31:00, 0:31:20]: The R3 district, which is what the applicant proposes, its purpose and requirements, it allows smaller lots as part of a planned development on sewer. Minimum lot requirements must have at least 12,000 square feet and be 75 feet wide. The minimum house size is 1,050. [0:31:20, 0:31:25]: uh square feet. Uh the applicant though plans to build, I believe, a minimum of [0:31:26, 0:31:26]: Houses of [0:31:27, 0:31:28]: Two thousand square feet. [0:31:29, 0:31:32]: The property characteristics, um [0:31:32, 0:31:38]: Again, it has 73.71 tot total acres, features a floodplain area near the center. [0:31:39, 0:31:40]: And a small pond. [0:31:41, 0:31:45]: Adjacent North Sound Drive is very narrow and curvy street. [0:31:46, 0:31:51]: Existing uses are res rural residential, minor agriculture, again the cell tower and a vacant land. [0:31:51, 0:31:57]: The cell tower is built in two thousand by Sprintcom and ATT colac co co locates. [0:31:57, 0:31:59]: It's equipment on the tower. [0:31:59, 0:32:10]: Uh I have some pictures. Here's uh one of the signs that was posted we posted on on North Salem Drive, uh next to the parcel, one of the five parcels. [0:32:11, 0:32:16]: Uh there's a sign that's uh near seven thirty two Brandon Road. [0:32:17, 0:32:22]: Uh, this is just a picture of a side the silo that's there, just to orient everyone. [0:32:23, 0:32:30]: Um, this is our third sign further down, closer to six one eight and near the most point across the street. [0:32:33, 0:32:37]: Here's a table of surrounding land uses. That's information that I already [0:32:37, 0:32:54]: covered. Um some other we do have some other uh since this property is uh it's surrounded on three sides. Uh the the Stockford city limits surrounds the property on three sides. And then of course on outside is um in the county. [0:32:55, 0:32:57]: These are some other surrounding um [0:32:57, 0:32:59]: subdivisions and land uses. [0:33:02, 0:33:12]: Okay, here's an aerial photo. Actually the applicant supplied this aerial photo. Um I was not able to enlarge it, but here's here's the subject property here. [0:33:13, 0:33:30]: And then we have uh Clark Meadow subdivision here, uh Moss Point subdivision, and some others. This one says the summon at Eagles Landing and Highlands at Eagles Landing. And there's some other subdivisions in in these areas that are in the county. [0:33:35, 0:33:37]: Those are the same maps that we've seen before. [0:33:39, 0:33:40]: Okay. [0:33:41, 0:33:45]: All right, so here's some facts about the proposed subdivision. [0:33:46, 0:33:50]: So um the applicant states are due to some to um [0:33:51, 0:33:56]: uh unbuildable areas in the center of the property that only forty seven point four nine acres will be developed. [0:33:57, 0:33:58]: Um [0:33:58, 0:34:01]: And the rest of the acreage is because of the [0:34:01, 0:34:04]: pond, a floodplain, and other open space areas. [0:34:04, 0:34:06]: Um and the cell tower. [0:34:07, 0:34:15]: So the site will be accessed from a boulevard style street off of Brandon Road across from Sperry Spraybray Drive, which serves [0:34:15, 0:34:20]: The Clark Meadows subdivision, there would be no secondary access provided. [0:34:20, 0:34:21]: So and then um [0:34:22, 0:34:28]: Uh the developer would provide an acceleration, deceleration lane and sidewalks at the entrance. [0:34:29, 0:34:36]: So these are some n numbers on the project size. There would be 147 homes, lots, and 147 homes. [0:34:37, 0:34:40]: The overall density one point nine nine dwelling units per acre. [0:34:41, 0:34:49]: Net density that is to account for the uh unbuildable areas, 3.08 acres, units per acre. [0:34:50, 0:34:53]: So the home size is applicant that's proposing to build [0:34:53, 0:35:08]: 2,000 square foot homes, uh, even though the R3 district allow allows homes that are about half of that size, 1,050 square feet. So these homes would be um almost double the size of what is allowed. [0:35:08, 0:35:15]: Uh the lot sizes, average lot size, n fourteen thousand one ninety-five square feet. [0:35:15, 0:35:22]: Some lots would have the minimum requirement of twelve thousand. They those would be in the center and in the back. [0:35:23, 0:35:30]: About half of the lots would have about between fifteen thousand and twenty thousand square feet. I determined this from looking at the [0:35:31, 0:35:33]: uh list actually on the site plan of [0:35:34, 0:35:36]: The size of every every lot. [0:35:37, 0:35:46]: Um eleven lots adjacent to Brandon Road would have at least fifteen thousand square feet, as I mentioned before. This would mirror the lot sizes of the lots within Clark Meadows. [0:35:47, 0:35:49]: subdivision that are adjacent to Brandon Road. [0:35:50, 0:35:53]: All lots would be at least seventy five feet wide. [0:35:53, 0:36:00]: And would have the filing yard set setbacks fifty feet in the front, ten feet at the side, forty feet at the rear. [0:36:01, 0:36:02]: Okay, let's move down. [0:36:04, 0:36:10]: Uh the s site design, subdivision would have a traditional design, cell tower and pond would remain. [0:36:11, 0:36:15]: Large open space area with walking trails would be located near the center. [0:36:16, 0:36:21]: An amenity area would be provided at the southwest corner uh near the pond. [0:36:21, 0:36:30]: And it would include a playground, picnic tables, fire print, fire pit grills, and a mail kiosk. Walking trail will be provided around the pond. [0:36:31, 0:36:37]: A fifty foot wide buffer would surround the property and a fence would be installed at the northern property line. [0:36:37, 0:36:45]: For utilities, Henry County water services available, but the developer will be required to extend a sewer line to serve the site. [0:36:45, 0:36:53]: Uh Mitch might also require easements. Uh applicant provided a letter from water and sewage authority saying that um [0:36:53, 0:36:58]: uh the sewer line needed to be extended, which a developer would have to pay for. [0:36:59, 0:37:04]: Here is the proposed site plan that that you saw before. Uh [0:37:08, 0:37:10]: Okay, let's see if I have uh I have some [0:37:11, 0:37:12]: And then here is [0:37:13, 0:37:15]: The same site plan in color. [0:37:16, 0:37:17]: And just got today actually. [0:37:18, 0:37:38]: Shows where all the lots are. So here we see this is the entrance across the Sprayberry Lane. It's a bullet boulevard divided right here. And then these lot this is lot lot number one here. And then these lots down here, 10 lots. So it's 11 lots here would all have sizes of at least 15,000 square feet fronting on. [0:37:38, 0:37:39]: Brandon wrote. [0:37:39, 0:37:45]: Um here's your pond and amenity area. Amenity areas would be around here. [0:37:45, 0:37:49]: In the center you'd have open space areas with some walking trails. [0:37:50, 0:37:51]: And um [0:37:51, 0:37:53]: And of course, I'm cold to sex. [0:37:54, 0:37:59]: So I made an enlargement of uh on a on the top of the site plan. [0:38:00, 0:38:01]: Uh up here. [0:38:02, 0:38:04]: Let me go to let me go to this other. [0:38:04, 0:38:05]: Up here. [0:38:06, 0:38:10]: See in these areas a but bunch of numbers. So I enlarge I enlarge that. [0:38:10, 0:38:11]: And [0:38:11, 0:38:12]: It's here. [0:38:12, 0:38:19]: So if you want these are some of the numbers that I already mentioned, number of units, lot width. [0:38:20, 0:38:21]: minimum lot area. [0:38:22, 0:38:29]: average lot area here the setbacks and then uh the the dense density and open space areas [0:38:30, 0:38:35]: Um the applicant provided a sample of what a house might look like. [0:38:36, 0:38:44]: Um, I guess this was from an another community that developer has has built. Some other photographs that I received. [0:38:45, 0:38:50]: I d I guess that's a fire pit. I don't have any information about'em, just receive'em. [0:38:50, 0:38:54]: Uh play proposed playground might look like this. [0:38:56, 0:39:01]: I guess this is a wall at the surrounding the property or near the entrance. [0:39:03, 0:39:15]: Staff analysis, so suitability of the proposed subdivision. Um, it's unlikely that the property would develop into additional rural residential agricultural uses due to its location. [0:39:15, 0:39:24]: Subdivision would be a reasonable use of the property due to the proximity of several other subdivisions adjacent to and surrounding the property. [0:39:24, 0:39:29]: The subdivision would meet the density requirements of the property's future land use designation. [0:39:30, 0:39:32]: suitability of the requested R three district. [0:39:33, 0:39:34]: Applicant would be able to develop. [0:39:35, 0:39:40]: Proposed subdivision R three if he extends a sewer line to the property in accordance with [0:39:40, 0:39:43]: Requirements of Henry County Water and Sewer Authority. [0:39:43, 0:39:49]: The R three district would allow proposed subdivision to have lot sizes that are that are um comparable. [0:39:50, 0:39:56]: Two lot sizes in Kark Meadows and Moss Point subdivisions, which ha do have sewer lines. [0:39:57, 0:39:58]: Okay. [0:39:59, 0:40:00]: Um [0:40:00, 0:40:06]: Cont suitability of the pro site plan subdivision would have traditional s design. [0:40:07, 0:40:17]: No secondary access would be provided at North Salem Drive, thereby eliminating possible safety hazards due to the narrow and curvy characteristics of the road. [0:40:18, 0:40:24]: Existing pond would be preserved and would be used as a focal point for several amenities. [0:40:24, 0:40:33]: The applicant is proposing to build many larger, many larger lots and larger homes than are required by the R3 district. [0:40:34, 0:40:50]: About half as I said, about half of the lots would have minimum size of twelve thousand square feet. Eleven lots in the front would have at least fifteen thousand square feet. And all of the all of the homes would have at least two thousand square feet. That's about double of what is required. [0:40:51, 0:40:52]: Uh uh [0:40:52, 0:40:55]: Fence would be installed along the northern side of the property. [0:40:56, 0:40:56]: Uh huh. [0:40:57, 0:41:01]: against the um rural residential and agricultural uses in that area. [0:41:05, 0:41:07]: Impacts on public schools. [0:41:07, 0:41:10]: So applicant submitted a letter from Henry County um [0:41:11, 0:41:19]: Uh, I guess it's Board of Education actually, that projections for additional classroom space would be based on two new students per residence. [0:41:19, 0:41:25]: And with a hundred forty seven homes, there would need twelve new classrooms to to serve. [0:41:25, 0:41:33]: 290 for four new students. However, the cost of new classrooms would likely be offset by the additional school tax. [0:41:33, 0:41:36]: that the subdivision residents would pay. [0:41:37, 0:41:46]: So impacts on adjacent streets. Um, applicant is not submitted to traffic study, thus traffic impacts on the surrounding area are unknown. [0:41:47, 0:41:52]: Uh number two, since one of the entrances will be located directly across from Sprayberry Drive. [0:41:52, 0:41:54]: Serving the Clark Meadows television. [0:41:55, 0:42:02]: it's possible that traffic light might be needed in the future at this intersection and the Henry County DOT would determine that. [0:42:03, 0:42:15]: To facilitate pedestrian movements, sidewalks should be installed on at least one side of the street. The applicant has provo proposed to provide them at at the entrance for sure. [0:42:15, 0:42:20]: To prevent traffic backups on Brandon Road and to facilitate turning movements. [0:42:20, 0:42:25]: An e acceleration and deceleration lane would be provided at the entrance. [0:42:25, 0:42:26]: Um [0:42:27, 0:42:31]: And those are also present at the two subdivisions across the street. [0:42:33, 0:42:48]: Um planning staff recommendations. I have a list of them. We recommend approval subject to the following conditions regarding the site plan. This is a long paragraph, but this identifies this specific site plan that was provided. [0:42:49, 0:42:56]: Uh subdivision sh shall be developed in accordance with site received submitted site plan revised site plan that received. [0:42:56, 0:43:01]: by City of Stockbridge Department of Community Development entitled Conceptual Site Plan. [0:43:01, 0:43:03]: Brandon Road track comprising [0:43:03, 0:43:05]: Sheet number one point one [0:43:06, 0:43:10]: As was prepared by Moorbass Consulting on December fourth, twenty twenty. [0:43:10, 0:43:14]: Said said plan is conceptual only and must meet [0:43:14, 0:43:21]: or exceed the requirements of the zoning resolution and these conditions prior to the approval of a land disturbance permit. [0:43:22, 0:43:27]: In the event that the recommended conditions of zoning cause the approved site plan to be substantially different. [0:43:27, 0:43:31]: The applicant shall be required to complete the concept review procedure. [0:43:32, 0:43:35]: prior to application for a land disturbance permit. [0:43:35, 0:43:37]: Unless otherwise noted herein is [0:43:37, 0:43:43]: Compliance with all conditions shall be in place prior to the issuance of the first certificate of occupancy. [0:43:44, 0:44:03]: So uh regarding subdivision uh design, again, these are this is our list of uh recommended zoning conditions. So A developer shall construct off-site sanitary sewer line extension into the property at developer's expense in cooperation with Henry County Water and Sewage Authority. [0:44:04, 0:44:07]: And this may require the um uh [0:44:08, 0:44:11]: may require the acquisition of any eas any easements. [0:44:11, 0:44:26]: The subdivision entrance off Brandon Road shall be boulevard style with a monument sign located uh uh outside of the public right of way. Such signage shall incorporate a water feature design. That this was the applicant's proposal. [0:44:27, 0:44:32]: The developers shall construct acceleration deceleration lanes at the entrance. [0:44:32, 0:44:35]: uh in compliance with Henry County DOT. [0:44:35, 0:44:40]: And the developer shall comply with the requirements of the city's subdivision ordinance. [0:44:42, 0:44:55]: Continuation, uh minimum of fourteen hundred forty seven lots and hundred and forty seven single family detached homes shall be constructed on the property. All lots that are adjacent to Brandon Road shall have at least fifteen thousand square feet. [0:44:56, 0:44:59]: A homeowners association shall be established. [0:44:59, 0:45:03]: Or a property management company shall be as secured [0:45:03, 0:45:06]: for the purpose of maintaining all common areas of the site. [0:45:07, 0:45:15]: Uh number three, regarding landscape design. A fence wooden or vinyl coated chain link, this was the applicant's proposal. [0:45:16, 0:45:19]: shall be constructed along the northern boundary of the property. [0:45:20, 0:45:34]: A minimum of 20% of the site shall be preserved as open space. Existing floodplain area, pond, and other open space areas shall be preserved and they shall include walking paths that are constructed of pervious materials. [0:45:34, 0:45:45]: Uh see the open space area near the existing pond shall include a minimum of the following amenities. And again, these is this is what the applicant proposed, a children's playground. [0:45:45, 0:45:51]: Central mail kiosk with a vehicle pull off area, two grills, or one fire pit and two picnic tables. [0:45:53, 0:45:53]: And the [0:45:54, 0:45:57]: The proposed amenities shall be constall installed [0:45:57, 0:46:01]: or constructed after fifty percent of the dwelling units have been constructed. [0:46:01, 0:46:06]: and before any land disturbance permits are issued for the development of additional lots. [0:46:09, 0:46:27]: Developers shall provide a minimum fifty-foot-wide buffer around the perimeter of the property with the exception of areas that are required for access or utility connections. F. Developers shall provide a landscaping plan which shall comply with the requirements of the city's landscaping buffers and tree protection ordinance. [0:46:27, 0:46:34]: G, sidewalks that are at least four feet wide shall be installed along at least one side of each internal subdivision street. [0:46:35, 0:46:40]: Now regarding architectural design, all homes shall have a two car garage at a minimum. [0:46:41, 0:46:46]: All homes shall have a minimum two thousand square feet of heated space, which the applicant proposes. [0:46:47, 0:47:05]: All homes shall have have exteriors which comply with the architectural standards of city ordinance number OR18452. This is an ordinance that has a lot that we've used for other subdivisions in the city and it lists types of approved construction materials. [0:47:06, 0:47:08]: And the percentage that needs to be used. [0:47:08, 0:47:09]: On the homes. [0:47:11, 0:47:29]: If possible is desi now these uh if possible, it's desirable for each side of every street within the subdivision to utilize two or more types of materials and two or more colors on the facades of the homes. This is this is to uh you know, to create some variety in a vi visual interest along the street. [0:47:29, 0:47:42]: And again, if possible, is desirable for each side of every street within the celldivision to portray a noticeable difference in materials and the colors of adjacent homes as well as architectural styles. [0:47:42, 0:47:47]: So th those last two are not mandatory. We're just saying those are those are desirable. [0:47:48, 0:47:59]: An official subdivision plat shall be approved by the city and recorded with Henry County Superior Court before any land disturbance or billing permits may be issued by the city to develop the subdivision. [0:48:00, 0:48:01]: And um [0:48:01, 0:48:10]: In compliance with section 12.12.003A of the city's zoning code, which is entitled Expiration of Approvals. [0:48:10, 0:48:30]: The zoning classification of the property may revert back to RA or to some other zoning classification after a period of 18 months if the mayor and city council chooses, and that is if substantial progress has not been achieved in the construction of the subdivision. [0:48:30, 0:48:35]: Uh substantial means progress means when the first inspection is carried out. [0:48:36, 0:48:39]: So those are the staff recommendations. [0:48:39, 0:48:40]: That that's all. [0:48:45, 0:48:48]: Uh Linda, you you mentioned the uh [0:48:49, 0:48:51]: Uh, what is it do? [0:48:51, 0:48:52]: The metals [0:48:52, 0:48:54]: Flock metals development. [0:48:54, 0:48:55]: Yes. [0:48:55, 0:48:58]: And uh the most point development. [0:48:59, 0:49:05]: Uh how many units are on those on that uh within that particular those particular subdivisions? [0:49:05, 0:49:06]: You know? [0:49:07, 0:49:08]: I I do not know. [0:49:10, 0:49:11]: Yeah. [0:49:11, 0:49:12]: Considerable size. [0:49:13, 0:49:14]: Yeah. [0:49:14, 0:49:17]: And they um the the plats show that they they have [0:49:18, 0:49:25]: um larger size locks in the front and smaller in the back. And in fact, so the locks in the back um [0:49:25, 0:49:35]: Actually the plates show that they have only only sixty five hundred uh sixty five hundred and seventy five hundred square feet at the at the rear. [0:49:35, 0:49:43]: Um that's what the plats show. We drove through there and and we didn't notice any difference uh just visually looking at the houses, but [0:49:43, 0:49:53]: But um those those lots in the rear are are mu much smaller than the ones in the front. This proposed um subdivision would would not have [0:49:54, 0:50:01]: such small lots. As I said, they must must have at least twelve thousand and and in fact at least half of them are going to have fifteen thousand. [0:50:02, 0:50:02]: Square feet. [0:50:03, 0:50:06]: Then can you go back to the um [0:50:06, 0:50:11]: the map where you the proposal the the land where it showed um [0:50:12, 0:50:13]: All the plats. [0:50:14, 0:50:16]: I think it's about twenty parcels. [0:50:17, 0:50:21]: Yeah, not not that one. Come down. Okay. Come down. [0:50:21, 0:50:24]: You move in too fast for me. Yeah. [0:50:24, 0:50:25]: This one. [0:50:26, 0:50:31]: Uh no, that was one that you had that actually outlined each lot. [0:50:31, 0:50:35]: It had the lots already uh mapped out. [0:50:38, 0:50:39]: That was the um [0:50:39, 0:50:40]: I have this one. [0:50:41, 0:50:47]: No, that was the proposed one where you had all of the lots laid out how the the the uh conceptual design of the subdivision. [0:50:48, 0:50:51]: With the various plus. Oh, the s the site plan. [0:50:51, 0:50:53]: Right. Yeah. Oh, the site plan. Okay. [0:50:55, 0:50:56]: Here we are. [0:50:59, 0:51:03]: That's the one I was talking about. Yeah, there you go. [0:51:06, 0:51:12]: So you're you're pretty much saying the lots in the I'm looking at the lots on the very the very last row. [0:51:13, 0:51:14]: in in in in this property. [0:51:15, 0:51:22]: You're saying that those lots are pretty much the same size as the one over in the meadows um subdivision? [0:51:24, 0:51:29]: I'm saying the lot lot these eleven lots here at the front on Brandon Road all have it. [0:51:30, 0:51:34]: Fifteen thousand, those are the s just like Clark Meadows across the street. [0:51:34, 0:51:48]: I was like, there is a list here which I I cannot I cannot enlarge, but I studied this. This this here on the right is actually a list of every lot and how and what its size would be. [0:51:49, 0:51:55]: And I from looking at that list, I saw that yes, there are some lots that have [0:51:55, 0:51:59]: Just a minimum twelve thousand square feet. I think there are some of these in here. [0:52:00, 0:52:07]: But at least half of them, I looked at Dola numbers, at least half of them had fifteen thousand or more square feet. [0:52:08, 0:52:11]: And there were some bigger ones like here on in the corners that had maybe [0:52:12, 0:52:17]: maybe twenty thousand at on the corner of a cul-de-sac. This I think this is the biggest slot here. [0:52:17, 0:52:20]: some bigger ones at the end of the cul-de-sac. [0:52:22, 0:52:27]: Okay, so Clark Meadows is a much smaller community than this one in particular. [0:52:28, 0:52:30]: The one this the one that that is being proposed. [0:52:31, 0:52:33]: Would more than double the size. [0:52:33, 0:52:36]: Uh I I'm not [0:52:36, 0:52:38]: I'm not sure. It was it was a [0:52:39, 0:52:42]: A good size, that one and and most point. [0:52:43, 0:52:45]: had several streets through there that we drove through. [0:52:47, 0:52:58]: What I'm looking at is the possibility of the size of Clark Meadows with the traffic that's gonna be coming pr that's gonna yield from this community being twice the size of [0:52:59, 0:53:00]: Of uh Clark Meadows. [0:53:01, 0:53:03]: Then that's gonna be a um [0:53:04, 0:53:09]: Th that's gonna be a situation that's really gonna have to be dealt with swiftly. [0:53:10, 0:53:15]: Right. I did mention that there might be a possibility of a need for a a traffic light. [0:53:16, 0:53:32]: in the future because we're gonna have the two streets um coming together, uh this boulevard of the subdivision and then Sprayberry Drive across the street. So they would line up exactly. And so I mean that was something that the Henry County DOT would have to determine. [0:53:33, 0:53:38]: Okay, so d the DOT could not determine that prior to uh [0:53:38, 0:53:58]: Could they couldn't determine this as a part of this plan because that street, I've actually driven that street, I've gone into those neighborhoods, I wanted to go to visually see what I was looking at, and that street does not have enough space to accommodate the additional traffic. [0:53:58, 0:54:00]: that you're proposing on putting into this area. [0:54:03, 0:54:07]: Right. So we do not have a traffic impact study from the applicant. [0:54:07, 0:54:09]: Uh nor do we have [0:54:09, 0:54:11]: comments from other agencies. [0:54:12, 0:54:13]: I would like to see one. [0:54:16, 0:54:27]: Mr. Chairman, um see what go ahead, Mr. Dumas. Uh yes. Uh and again I apologize for my camera. I have a question for staff. Um [0:54:28, 0:54:30]: Given the [0:54:31, 0:54:33]: Parcel in question is [0:54:34, 0:54:36]: Almost surrounded by [0:54:37, 0:54:41]: Unincorporated Henry County. It's a peninsula, if you will. [0:54:42, 0:54:44]: Oh I I wonder [0:54:45, 0:54:48]: If you all deemed it appropriate or did you [0:54:49, 0:54:52]: Reach out to the planning commission for Henry County. [0:54:53, 0:54:59]: in dialogue with regards to what what's being anticipated putting in in this track. [0:55:03, 0:55:05]: Um, only insofar as [0:55:05, 0:55:09]: inquiring about other surrounding subdivisions, but as far as [0:55:10, 0:55:10]: They're [0:55:11, 0:55:12]: Future plans, no. [0:55:12, 0:55:14]: That did not occur. [0:55:14, 0:55:15]: Okay. [0:55:15, 0:55:20]: You know, this the the thing about this project, this project is more than double the size of uh [0:55:21, 0:55:22]: metals and uh [0:55:22, 0:55:23]: Well it's most important. [0:55:26, 0:55:29]: Yes. Well fun, I'm saying they have sixty seven homes there. [0:55:30, 0:55:32]: And we talk about a hundred and forty seven here. [0:55:33, 0:55:34]: Um [0:55:34, 0:55:37]: That's that's that's uh that that's uh [0:55:37, 0:55:41]: that density is is going to be traumatic. [0:55:42, 0:55:45]: I agree. You know, I mean it it's it's it's um [0:55:47, 0:55:47]: You know. [0:55:48, 0:55:53]: I mean to double a density like that in the area and you already have traffic problems there now [0:55:54, 0:55:55]: Um [0:55:57, 0:56:00]: Uh I I don't I I don't see it, you know. [0:56:00, 0:56:09]: Uh, one of the things I think that we need to do with situations like this is that we really need to go out and have a community, meeting in the community and have those who live there. [0:56:10, 0:56:14]: provide their input, you know, and I know we can't do it now because of COVID. [0:56:15, 0:56:15]: But [0:56:16, 0:56:21]: most certainly this is gonna have a tremendous impact on those adjoining community subdivision. [0:56:21, 0:56:25]: If if if if if Meadows only has sixty seven homes, we bring in a hundred and [0:56:25, 0:56:26]: Forty seven. [0:56:27, 0:56:31]: Uh Maw's point, I don't know how many here, but it it's again it's another small subdivision. [0:56:32, 0:56:33]: Um [0:56:34, 0:56:37]: You know, how how how how you gonna accommodate the the traffic? [0:56:38, 0:56:40]: How you accommodate the um [0:56:40, 0:56:41]: The infrastructure? [0:56:43, 0:56:46]: uh, et cetera. You know, I mean this is is i i [0:56:47, 0:56:52]: And not to mention a storm, uh there I haven't seen a storm drape. Yeah. [0:57:01, 0:57:01]: Okay. [0:57:06, 0:57:14]: And it's gonna be a great impact with the school being right there. And that's pretty much gonna be the main exit. [0:57:14, 0:57:18]: for people going to work, people trying to get to school. [0:57:19, 0:57:22]: early in the morning you have school buses, you have uh [0:57:23, 0:57:43]: just regular traffic coming through daily, it's going to be a mess. It's yes, to put it n that's the best that you really can put it. Uh the quality of education for the children, it has to it has to be considered because with um what you're bringing in that many homes, you know, yeah you may see [0:57:43, 0:57:48]: say some households, the average household has two children, but that's not always the case. [0:57:49, 0:57:54]: And then you have to worry about the impact that's gonna have on classroom sizes as well. [0:57:54, 0:57:57]: So these things to me are very important. [0:57:58, 0:58:18]: Go ahead. No, I'm sorry. These things to me are very important because when you have an a community that has established itself and they're already strained and dealing with the current situation, and then you compile additional items on top and bring it in another subdivision. [0:58:17, 0:58:22]: which is gonna create more um a bigger issue than what they have now. [0:58:22, 0:58:42]: We really need to we really need to consider the the values of of the homes in that area. How are these homes going to impact the values of the homes that are over there? And I haven't heard anyone mention that whatsoever, but all of these things need to be considered. Um and I'm wanna yield to the rest of the board to [0:58:42, 0:58:46]: uh to um voice what opinions you may have on this. [0:58:48, 0:58:50]: on this pro proposed project. [0:58:50, 0:58:57]: You know, the traffic, you know, uh the assumption is that you got two cars to a household you're saying you got two car garages. [0:58:57, 0:58:59]: That's not necessarily true. [0:58:59, 0:59:01]: You may have four cars then. [0:59:01, 0:59:03]: And just uh imagine the model of that traffic. [0:59:04, 0:59:10]: Say for instance, you got a mother and father in the house, they each have a car. Maybe you got a couple of kids, they each got a car. There's four cars. [0:59:12, 0:59:14]: And uh that's gonna have a tremendous impact. [0:59:15, 0:59:16]: On traffic. [0:59:16, 0:59:18]: uh ingress and egress. [0:59:18, 0:59:22]: And my other concern is that there's only one exit out of this place. [0:59:23, 0:59:25]: Only one X. What if there's an emergency? [0:59:26, 0:59:27]: How do you get through? [0:59:27, 0:59:28]: How do you exit? [0:59:29, 0:59:34]: So originally the applicant had proposed the secondary access on North Salem Drive, but then [0:59:35, 0:59:40]: remove that due to concerns about the the road itself being very narrow, being very [0:59:40, 0:59:43]: very curvy and uh and and unsafe. [0:59:43, 0:59:46]: To accommodate the additional traffic. [0:59:47, 0:59:53]: Uh Mr. President. What if you have an emergency and you got five vehicles coming in, you only have one ingress? [0:59:54, 0:59:58]: We had our fire marshal look at this and he uh was okay with it. [1:00:00, 1:00:01]: Mr. Chairman. [1:00:02, 1:00:05]: Sure. Go ahead, Mr. [1:00:05, 1:00:07]: The attorney for the applicant. [1:00:08, 1:00:11]: mentioned in her earlier statement that she [1:00:12, 1:00:15]: was prepared to make a presentation to the board. [1:00:16, 1:00:16]: Yeah. [1:00:17, 1:00:17]: And [1:00:18, 1:00:20]: I think it would be appropriate. [1:00:21, 1:00:22]: For us too. [1:00:22, 1:00:23]: Here [1:00:24, 1:00:25]: What she has to present. [1:00:28, 1:00:29]: I think that was Miss Battle. [1:00:30, 1:00:31]: Yes. [1:00:32, 1:00:33]: Miss Bell, are you there? [1:00:34, 1:00:34]: I am. [1:00:35, 1:00:55]: You wanna do your presentation? I mean, I'm sure you heard all the questions and interesting that we have. And I'm sure you're prepared to address them. So absolutely. Um I um Michelle Battle with Battle Law, one West Court Square, Decatur, Georgia, 30030. [1:00:55, 1:01:15]: The things that Linda went over. I think that she did a very thorough job on what the project is. Um, but I would like to address uh many of the issues that you all have raised. First and foremost, we actually had a community meeting that was very well attended. We had over 35 people, I believe, at that meeting uh last Thursday. Um, we held that meeting in [1:01:15, 1:01:35]: order to give the community an opportunity to speak out with regards to the questions and concerns that they had raised regarding the project. We did hear a number of comments, many of which surrounded uh traffic related issues. There certainly are issues um with um uh North Salem Road. [1:01:35, 1:01:55]: That was one of the main uh concerns that they had. Um, they seemed appreciative of the fact that at least we cut off that entrance, but that did not resolve the safety and other concerns that they had that traffic would come off of Brandon Road and eventually make its way onto North Salem Road. Um we cannot resolve the issues of North Salem Road. [1:01:55, 1:02:15]: We certainly have no issue with trying to contribute towards resolutions of issues with regards to North Salem Road. I don't know if the city had ever even considered just cutting that street off from access from Brandon Road in order to eliminate cut-through traffic. And with it being such a narrow. [1:02:15, 1:02:35]: Windy Road, but we are not contributing direct access onto North Salem Road. With regards to Brandon Road, we have amended our site plan to show the XL D cell lane in the front that mirrors what is across the street in Clark Meadows so that we have the XL. [1:02:35, 1:02:55]: Cell, D cell, and the sidewalk in front. Um, there's been much talk about um what is the size of Clark Meadow. Um I actually just sent over to um Linda a copy of the cover page from uh the recorded plat for Clark Meadows. Clark Meadows has 142 lots. [1:02:55, 1:03:15]: That were platted for that community, 142 lots that were platted. And I've sent her the cover sheet to that and would be happy to as well. I can either share my screen to show the layout matches exactly what you will see on the ground and in the overhead pictures. [1:03:14, 1:03:34]: That we have provided to you all. With regards to the density, therefore, we are very consistent. In fact, we have over 73 acres on our project. Clark Meadows only has, I believe, 56 acres. And so [1:03:34, 1:03:54]: Um with 147 lots, we are certainly consistent with what else is already in the area. When you also look at our lot sizes, our lot sizes are very consistent. Um, in fact, larger um than some of the lots within uh Clark Meadows. Our average lot size is over 14,000 square feet. We've got 15. [1:03:54, 1:04:14]: 15,000 square feet lots lining um Brandon Road. Um, and our minimum lot size is 12,000 square feet. In terms of our responsiveness to some of the issues raised by the community, um, there were a number of individuals because originally we had a 30-foot buffer around the perimeter. [1:04:14, 1:04:34]: Of the project. As a result of comments and concerns raised by those abutting property owners, we actually increased the buffer to 50 feet as opposed to 30 feet, and we applied that even in areas where we were not requested. So that buffer now is around the entire perimeter at 50. [1:04:34, 1:04:54]: feet. With regards to the interior layout and the access points, again, we closed off that access point at the request of the community with regards to not having access onto North Salem Road, even though we have frontage on North Salem Road. [1:04:54, 1:05:14]: The one access point that we have, however, is consistent with the one access point that is at Clark Meadows. They only have one access point as well. On our site, we will be providing for extensive amenity areas. We've got the interior. [1:05:14, 1:05:34]: with the lake um and the dock and the um uh amenities around the the totlot and the other amenities around uh the lake as well as um a walking trail area um for exercise for those that live within the community um we have sidewalks on one side of the street as um is required [1:05:34, 1:05:54]: um by the uh by the city. Um and in terms of price points with these lots, um we will be in the high uh 200s um to low threes by the time um this project gets built out. Um we certainly understand uh the concern about traffic and safety uh in this area. [1:05:54, 1:06:14]: We're concerned about traffic and safety in this area as well and want to do our fair share to make sure that um the residents that live in this community as well as in the surrounding area are not overly burdened by this project. But at the same time, um there's a lot of land in this area. Um we are bringing [1:06:14, 1:06:34]: Sewer down into this area, which may benefit others that have existing homes in the area or those who may choose to build as well here in the future. That we now are bringing that sewer, which is extremely expensive, but we are doing in order to facilitate the development of this project. [1:06:34, 1:06:54]: So we would be happy we've got our engineer here, Steve Moore, and Alex McCart to answer any other questions that you all may have. We recognize and have no problem going back and having a follow-up meeting with the community between now and the city council meeting if there's a final uh decision by this. [1:06:54, 1:07:14]: Board. If not, we certainly again are prepared to continue those conversations. We had not had a chance to go back to them with the modifications that we have made since our last call, a Zoom call that we had on last Thursday. But again, we are prepared to continue that dialogue with [1:07:14, 1:07:34]: them and to try and continue to address the issues. But we we unfortunately cannot fix all of the traffic issues around in that area. But again, our project is certainly consistent with other projects that have been approved in the area, including again Clark Meadows. So we will respectfully request a recommendation [1:07:34, 1:07:42]: Recommendation of approval based on the conditions provided by staff. And we are here to continue to answer questions that you may have. [1:07:42, 1:08:02]: Ms. Ballard, you said you had a community meeting out there, correct? Yes, sir. We did. And where did you locate that meeting yet? This is you know, we got COVID out here now. Um we had we had our meeting virtually. Um as a zoning attorney, I have those all the time now and um we are pretty efficient at doing them. Um and that's pretty much what I'm gonna stay with actually because they've been [1:08:02, 1:08:09]: better attended by those meetings than actually having physical meetings. Approximately how many people did you have at that meeting? [1:08:09, 1:08:24]: I believe we had roughly thirty five. I have to check the list, but I believe it was a little over thirty five people that attended that meeting. You know, my concern is that we posted notices um in the entrances to the subdivisions. My concern is that that's uh [1:08:24, 1:08:31]: That's a low number. That that's you know, that that's a low number. I'm saying I'm thinking about the density, the the increased density in the area. [1:08:31, 1:08:40]: If there was some way that we could cause, you know, you know what I consider when when I when I look at something like this, would I want that next to me? Would I want that to come in on me? [1:08:41, 1:08:47]: Uh and so I have to look at it from that perspective, trying to be objective. I had would I want something like that next to me? [1:08:47, 1:08:54]: And so what if we could, if we could have another Zoom meeting with the community to get their direct input. [1:08:55, 1:08:57]: I think that would be better. I I mean my [1:08:58, 1:09:02]: My conscience would be clear if they participate and I could hear their exact concerns. [1:09:03, 1:09:09]: I can hear their concerns. Absolutely. I I have no problem with that. You know, and we could all join in. [1:09:10, 1:09:13]: And we can make an informed decision based on that. [1:09:13, 1:09:16]: I would not want to just dump this on anyone. [1:09:16, 1:09:17]: Or any community. [1:09:18, 1:09:18]: Okay. [1:09:19, 1:09:39]: Well, again, we attempted to um have a meeting. Um, quite honestly, in in my um uh practice, uh I can tell you that um it normally if we had a face-to-face meeting, 35 would have been a great number uh to have at a meeting. Um, but uh I understand that there are a lot of people that are concerned about the project. [1:09:39, 1:09:59]: that are directly impacted by it. We have no problem continuing that dialogue and you know hosting another meeting. We are around uh the holiday time, so we'll have to figure out a date and time that makes sense. But um we certainly have no problem with um continuing and making sure that people are well informed. [1:09:59, 1:10:01]: informed about what we are proposing. [1:10:01, 1:10:07]: What I would like to see, Ms. Battle, is is to send out notices to the residents, particularly those in uh [1:10:07, 1:10:10]: uh moss porn and and clock metals. [1:10:11, 1:10:14]: 'Cause they're going to be direct they're going to be directly impacted by this. [1:10:15, 1:10:16]: Uh [1:10:16, 1:10:19]: I'd say it's somewhere. Sixty seven home we could get. [1:10:21, 1:10:27]: half of each one of those communities to participate, at least have some input from the community, how this is going to impact them. [1:10:28, 1:10:29]: We can make an informed decision. [1:10:30, 1:10:31]: You know, um [1:10:33, 1:10:37]: Uh but the dump community next to them that's twice their size. [1:10:39, 1:10:43]: I wouldn't want that dumped on me. And I can imagine the traffic hazard that they're talking about. [1:10:44, 1:10:52]: Uh I think one I read something where there's a curve of mailbox where people speed down there, knocking the mail down mailbox down. [1:10:52, 1:10:55]: four or five times a year accidents and whatnot. [1:10:56, 1:11:01]: then there's impact on the school. But I just think uh so some some community input on this. [1:11:01, 1:11:07]: before we make a decision would be in all of our best interests, both for the city as well as the community. [1:11:08, 1:11:28]: Uh and and can I say one thing with regards to the traffic? Um there's no question that the city of Stockbridge, as well as many communities around here, are growing. And there has to be a cooperative effort amongst all to address um traffic. Traffic is an issue in every last single community um that I do in. [1:11:27, 1:11:47]: Practicing. Everyone has exactly the same issue. And it's understandable because the Metropolitan Atlanta traffic is horrible. And I can't say that I don't want to blame anything on any particular like GDOT or something like that, but clearly there was not enough preparation. [1:11:47, 1:12:07]: For um the boom in population that we have had. And so with that, um, I say again, we can't fix all the issues, but what is clear is that there is a lot of vacant land in this area. And um, as individuals decide that they want to move on or um they [1:12:07, 1:12:27]: have um relatives who are of advanced years and now they're willing to sell property. Um you're gonna have more and more folks coming through, whether it's at the density we're proposing or even slightly less, it's still the same issue, which is more people coming into the area. And so I'm not sure whether or not the cities um got any type of transportation plan. [1:12:27, 1:12:47]: With regards to improving traffic conditions and addressing those types of issues. But we certainly want to work cooperatively with the city and to the extent the county to address whatever issue we can with regards to our project. But we believe that we've done what we have been asked of up to this point. [1:12:47, 1:13:07]: And I think we were going to try and get some uh traffic count uh numbers for you all. Um but we will certainly talk with the staff, with um Linda and um uh Mr. Knighton to find out what else um might be asked of us to do. I'm looking at the third paragraph on it states that that that no traffic impact study was submitted. [1:13:07, 1:13:12]: I'm not concerned about that. And I realize that we I realize that we're going to grow. [1:13:13, 1:13:15]: The populations are shifting, et cetera. [1:13:15, 1:13:28]: But I think that we should address the growth and the shifting consciously to take everything. Many we're not gonna be able to cure all ills. We're not gonna be able to address every concern, but I think we can reach a happy medium. [1:13:28, 1:13:48]: Uh by taking some additional steps here and there. And that's the only thing I'm suggesting. I'm suggesting that we, if we can have another Zoom meeting with the community so we can find out exactly what they're interested and concerned are. Not that we're going to stop growing because you got you don't want this or you don't want that, but at least have some community input so that we as a board act normally [1:13:48, 1:13:53]: on behalf of the city of Startbridge and the community can make an informed decision in this regard. [1:13:53, 1:13:54]: Yes, sir. [1:13:54, 1:14:02]: And I would actually like to know what steps are being um taken. How is this gonna impact that area floods? [1:14:02, 1:14:03]: Um quite a bit. [1:14:04, 1:14:07]: when it rains, how what type of impact? [1:14:07, 1:14:11]: is your project gonna have on the current flooding situation? [1:14:12, 1:14:26]: You said you had your engineers online on board already. So if they could please just address that for me and and give me a just briefly tell me how how is this flooding that's currently occurring in that area? How how [1:14:26, 1:14:28]: How is it gonna be impacted? [1:14:31, 1:14:34]: Yes, ma'am. Uh this is Steve Morgan. Um [1:14:34, 1:14:40]: We have an obligation as engineers to uh protect the health, safety and welfare [1:14:40, 1:14:41]: of the general public. [1:14:41, 1:14:42]: And [1:14:43, 1:14:49]: the state and the county and the city has stormwater ordinances that ensure that we do that. Um so [1:14:50, 1:14:52]: Uh we will construct uh [1:14:52, 1:14:55]: Detention facilities on the property. [1:14:55, 1:14:58]: uh that will not only slow the stormwater down [1:14:59, 1:15:02]: But also clean that storm water. [1:15:02, 1:15:05]: before it's released into the existing [1:15:05, 1:15:08]: uh conveyance system which is the creek and the floodplain to the [1:15:09, 1:15:09]: Uh on the [1:15:10, 1:15:11]: I guess it's the [1:15:11, 1:15:13]: Eastern edge of the property. [1:15:13, 1:15:14]: Um [1:15:14, 1:15:18]: But there is in during the community meeting we had uh one [1:15:18, 1:15:20]: resident who did have some [1:15:20, 1:15:22]: Some drainage issues from [1:15:22, 1:15:24]: uh runoff coming from this property. [1:15:24, 1:15:25]: We insured her. [1:15:26, 1:15:27]: as well that we would [1:15:28, 1:15:39]: uh that her condition will be better after the subdivision is developed than it is today because we will capture those stormwaters in those areas where the flow is concentrated and capture it in a pond, slow it down, treat it. [1:15:39, 1:15:41]: And it will be released at a rate [1:15:42, 1:15:42]: It is [1:15:42, 1:15:45]: Likely slower than it's coming to her now. [1:15:45, 1:15:50]: Uh but uh yes, all those issues will be resolved. We won't be allowed [1:15:50, 1:15:51]: To construct [1:15:51, 1:15:53]: A a subdivision that [1:15:53, 1:15:55]: Worsens a drainage condition. They're [1:15:55, 1:15:58]: Have been rules put in place for many years that ensures [1:15:59, 1:16:00]: that that that that can't happen. [1:16:03, 1:16:04]: Mr. Chairman. [1:16:04, 1:16:05]: Yes. [1:16:05, 1:16:06]: I have. [1:16:06, 1:16:08]: uh questions for [1:16:09, 1:16:11]: Miss Battle, please. Uh [1:16:11, 1:16:13]: Actually, I have four questions. [1:16:13, 1:16:18]: And I can ask'em all at once or I can take'em one at a time. How how would you prefer? [1:16:19, 1:16:28]: Um if you could do one at a time so that way I can remember whether Okay, that's fair or not. But you asked that's fine. And I'll try to be brief in my response. [1:16:29, 1:16:33]: Y you probably already answered one of'em already, but [1:16:33, 1:16:35]: I'm gonna ask it again anyway, but [1:16:35, 1:16:39]: My first question would it be a fair assessment to [1:16:39, 1:16:41]: refer to [1:16:41, 1:16:43]: Your proposed development as [1:16:43, 1:16:44]: Starter homes. [1:16:46, 1:16:48]: No, I would not say that that is a fair assessment. No. [1:16:51, 1:17:11]: Um the these homes will be at uh price points in the high uh two hundreds and uh to the low three hundreds. Um I don't consider that to be a starter home. Uh I know when I got my home, it was like a hundred thousand dollars. I was a starter home. I think starter homes these days are um around maybe a hundred and fifty to two [1:17:11, 1:17:16]: two hundred thousand, but I wouldn't consider a two hundred seventy five to three hundred [1:17:16, 1:17:17]: Yeah. [1:17:17, 1:17:19]: Yeah, I got that. [1:17:20, 1:17:27]: Um the my next question. You gotta have a lot of money to have a$300,000 home. Uh that in my opinion. You gotta make a decent fame. [1:17:27, 1:17:36]: I understand. The uh increase the buffer from thirty feet to fifty feet. Uh isn't that gonna reduce the lot sizes? [1:17:36, 1:17:56]: Um no, actually our s um lots around the perimeter were actually fairly deep. We already had a 30 foot um buffer along the um rear of the site. Um I don't know if we can put back up the site plan, but the the next twenty feet of that um will be in the rear yard of those homeowners. Um we did discuss [1:17:56, 1:18:16]: whether or not um well what we would do on the on the plat and this is done in in other communities where um the rear will be undeveloped um and so that will be an undisturbed i believe an undisturbed buffer so there will be full tree coverage whatever coverage is there along that perimeter um and that will be on [1:18:16, 1:18:36]: on the plat. And if any neighbor or um homeowner interferes with that, the community um or any abutting property owner would have the right to get them sited for removing trees out of a undisturbed buffer. So that buffer will be a part of part of it, the first 20 feet of it will be a part of the lot and then the other 30 feet [1:18:36, 1:18:39]: will be owned by the um HOA. [1:18:41, 1:18:44]: Okay, my final question. [1:18:46, 1:18:49]: What did your anticipated build out period for this subdivision? [1:18:51, 1:19:11]: Um, if this project were approved, um, we anticipate that it would take um by the time we get through the uh land development permitting process, um, that it would take anywhere from um a year to 18 months to do all of the infrastructure installation. Um, and then we would be looking at uh probably another [1:19:11, 1:19:26]: uh couple of years um for complete build-out. So um I don't believe that you would see any homes go on the lots until uh probably sometime in 2022. Um and probably build out would take maybe to 2022. [1:19:26, 1:19:33]: twenty twenty four or something like that. So depends upon how fast the houses go. Four four to five years. [1:19:35, 1:19:40]: I don't know that it would take well, four you mean to complete the entire project? To finish, yeah. [1:19:41, 1:19:41]: Yeah, yeah. [1:19:42, 1:19:45]: Ten years. About three to five years. [1:19:46, 1:19:48]: Not not ten years for a hundred and forty two lots. [1:19:49, 1:20:01]: Well, I mean the the the other piece of that, uh and and I'm sure this is something that all developers deal with is the economy. Uh I mean, w we can do our best guess estimation, but if the economy tanks [1:20:02, 1:20:04]: It could be ten years. [1:20:04, 1:20:12]: And you you could it could be a PVC form for three or four years before some some construction resumes. [1:20:14, 1:20:18]: Th there is always that possibility. We don't know what the market will bear from that perspective. [1:20:19, 1:20:22]: Okay This is Dave Planton. I'm sorry I was unmuted. [1:20:23, 1:20:28]: Um, I have a question to ask and then a couple of statements to make for consideration if we have time. [1:20:30, 1:20:30]: Go ahead. [1:20:31, 1:20:33]: Uh my first question is with the [1:20:33, 1:20:36]: traffic impact study, why was one not done? [1:20:37, 1:20:39]: Knowing what we know about Brandon Road. [1:20:39, 1:20:44]: And specifically the Clark Meadow subdivision not even half built out yet. [1:20:45, 1:20:46]: I know they have a lot more lots. [1:20:46, 1:20:50]: available to build out than they currently have built out. [1:20:51, 1:20:53]: Plus the fact that Brandon Road is now [1:20:54, 1:20:58]: A major cut through from forty two highway over to Campground Road. [1:20:58, 1:21:02]: not just the people that live there that that utilize that corridor. [1:21:03, 1:21:06]: It's a now major cut through when forty two backs up. [1:21:07, 1:21:09]: Like it does going into McDonough. [1:21:09, 1:21:12]: Knowing the the the traffic situation in that area [1:21:13, 1:21:16]: compounded by the school, why wasn't a study done? [1:21:18, 1:21:35]: Um, I can only to say for myself that um with regards to many of the traffic issues, um I don't know that we were fully aware of some of those, particularly the ones along um North Salem Road, but um there has certainly been some discussion on our part about providing one. We were [1:21:39, 1:21:39]: Not [1:21:41, 1:21:51]: asked to provide one that I that I know of. Um that is a part of the applications, but um we were not provided with that information. So um obviously that's something that we're gonna have to reflect on and address. [1:21:59, 1:22:00]: Mr. Chairman. [1:22:00, 1:22:10]: Yes. Are are we gonna have a public comment uh component tonight or are we relying strictly on the Q and A's and the chats? [1:22:11, 1:22:12]: Um [1:22:15, 1:22:21]: We were supposed to. I don't know whether Lo uh Linda had the technology or had the people set up to do that. [1:22:22, 1:22:25]: But what I'm thinking well what I'm thinking, what I'm thinking, what I'm thinking. [1:22:26, 1:22:29]: Is that I think we've addressed most of the points here and [1:22:30, 1:22:31]: Um [1:22:31, 1:22:35]: My estimation is that we're not prepared to make a decision at this point. [1:22:36, 1:22:41]: Uh Miss Babel says she's going to have another community meeting and we're going to be invited there. [1:22:41, 1:22:46]: So that we can have an opportunity to hear both sides simultaneously before we make a decision. [1:22:47, 1:22:52]: Um so that being the case, I'm not saying that's it, but I will make a motion to that effect. [1:22:52, 1:22:58]: Uh uh that we address this at a later date before we bring in the rest of the camera. [1:22:58, 1:22:59]: I don't think [1:22:59, 1:23:04]: This the magnitude of this development, I don't think we can make a decision without hearing from the community. [1:23:06, 1:23:12]: I agree and I'd like to request that a traffic impact study be completed before we [1:23:14, 1:23:15]: take up this issue again. [1:23:18, 1:23:21]: Mister Chairman, I I agree with that. Also [1:23:22, 1:23:23]: Miss Logan. [1:23:24, 1:23:24]: Yes. [1:23:24, 1:23:29]: Are you reading the attachments on the email that you're sending to us? [1:23:30, 1:23:30]: Mm-hmm. [1:23:31, 1:23:32]: Which attachments? [1:23:33, 1:23:35]: Well the first original attachment [1:23:35, 1:23:36]: Attachment that you sent to us. [1:23:37, 1:23:40]: was kind of misleading and it was addressing [1:23:41, 1:23:41]: Uh [1:23:42, 1:23:44]: other counties or why things should be [1:23:45, 1:23:45]: Uh [1:23:45, 1:23:46]: Approved. [1:23:47, 1:23:50]: I thought that was unfair because of the fact that [1:23:50, 1:23:54]: We never had all the information pertaining to the property. [1:23:55, 1:23:58]: But we get this documentation stating [1:23:59, 1:24:01]: While we should approve. [1:24:01, 1:24:03]: this rezoning. I I was kind of [1:24:04, 1:24:06]: a little bit set back by that. [1:24:07, 1:24:12]: I'm not sure I know what you're referring to as far as attachment. I mean [1:24:13, 1:24:18]: No well I I would suggest there was a ruling made in uh Fulton County and uh [1:24:19, 1:24:21]: That was presented to us first. [1:24:22, 1:24:24]: When we should have had all the documentation. [1:24:25, 1:24:27]: pertaining to what these people were gonna do with this property. [1:24:28, 1:24:41]: is what I'm referring to you about on these attachments. Fulton County? I don't remember seeing anything about Fulton County. Well you you do. I can print it out and and make sure you get a copy of it or or either I'll take a snapshot of it and send it to you. [1:24:41, 1:24:45]: To give you some understanding. I I was a little bit set back because I thought [1:24:45, 1:24:46]: It was [1:24:46, 1:24:51]: a a bit of intimidation to approve this property. [1:24:51, 1:24:57]: uh zoning request. I I was a little disturbed by it because uh I didn't have actual information. [1:24:58, 1:25:00]: Relating to all [1:25:00, 1:25:01]: The uh [1:25:01, 1:25:04]: property designs and everything else, but I get this [1:25:05, 1:25:10]: first attachment that you sent and uh when I started reading it, I was like, whoa. [1:25:10, 1:25:14]: Why am I getting this when I don't even know enough about the problem? [1:25:14, 1:25:20]: I I'm sorry, I I don't know what detachment you're talking about. Uh who was detachment from actually. [1:25:21, 1:25:23]: Mr. Tibodore, can I interrupt for a second? [1:25:23, 1:25:24]: Yes. [1:25:25, 1:25:30]: Why don't you address that with Linda privately and uh we can finish this up today? [1:25:30, 1:25:38]: Uh I don't think well, I'd like to make a motion on this project. I'd like to make a motion that we table this matter until we have that community. [1:25:39, 1:25:40]: uh meeting. [1:25:40, 1:25:44]: And that we get input from the community before we make a decision on this. [1:25:45, 1:25:46]: I second that motion. [1:25:47, 1:25:51]: Because we definitely need more input input from the public. [1:25:52, 1:25:54]: prior to making such a important decision. [1:25:56, 1:26:16]: All right, it's been moved and seconded. All those in favor let it be known by the sign of I Mr. Chairman, Mr. Chairman, before we vote, would it be appropriate to attach a date certain relative to the body? Well we got to get the date up in the air. Okay. I understand that. We have to get the date from this battle. [1:26:16, 1:26:19]: Battle is going to have another public Zoom meeting. [1:26:20, 1:26:21]: And so we're gonna [1:26:22, 1:26:23]: Depend on her for the date. [1:26:24, 1:26:25]: Before we can all get together. [1:26:26, 1:26:26]: Miss Ballum. [1:26:28, 1:26:28]: Ви зберу. [1:26:29, 1:26:29]: Yes, sir. [1:26:30, 1:26:32]: Yeah, are you gonna you have any idea when you're gonna set that up? [1:26:35, 1:26:53]: Um I'm going to assume with the holidays that it will not make sense to have the meeting uh this month. Okay. So um what when is your next um planning commission meeting? Linda. I would assume the third the third Thursday in January. January January twenty eighth. [1:26:53, 1:26:55]: Twenty eighth or the twenty first? [1:26:56, 1:26:56]: Me eight. [1:26:57, 1:27:16]: The twenty eighth. Okay. So um I'm gonna assume that it will be probably around the eighteenth, somewhere the week of the eighteenth. Of January. Um yes, sir. Okay. Then let's do it. It'll be that either the week of the eleventh or the week of the eighteenth, somewhere the Linda has all of our [1:27:16, 1:27:33]: Linda has all of our email addresses, so she we would like to be notified. I I mean disappointed that we weren't notified of your previous meeting, but you know bygones be bygones. If you would notify us of of this future meeting, it would be really appreciated. [1:27:33, 1:27:50]: I I I have no problem doing that. I I will say this. I typically do not ask planning commissioners to these meetings because you all sit, depending upon how you look at it, in a quasi judicial position. So I don't typically ask planning commissioners because I'm usually told they don't attend those types of meetings, but [1:27:53, 1:28:00]: I understand what your protocol is. This is the first time I've been in in Stockbridge. So I apologize for that. And we'll make sure in the future that you get those kind of notices. [1:28:00, 1:28:02]: Well, the I mean this is [1:28:02, 1:28:05]: Just something I'm suggest. That's not part of our [1:28:05, 1:28:07]: uh protocol. [1:28:07, 1:28:10]: However, because of the magnitude of this project. [1:28:10, 1:28:27]: And the uh query that we're getting from neighbors and whatnot, uh, I think it's incumbent upon us to hear from the community before we make this decision. You saying Jad between January the eleventh and January 18th, you'll have this meeting set up, we can hear from the community. [1:28:28, 1:28:30]: And uh at the next meeting we can make a decision. [1:28:32, 1:28:37]: So Mr. Chair Mr Chairman, if I may ask a qu a question, you know [1:28:37, 1:28:38]: If [1:28:38, 1:28:40]: If she conducts a community meeting [1:28:41, 1:28:46]: And a quorum of the planning commission is there. Are are you all intending [1:28:47, 1:28:53]: to participate in the in that discussion or simply listen. Um, because if you participate [1:28:54, 1:29:03]: Uh it becomes an official meeting of the planning commission, subject to the Open Meetings Act and all that sort of stuff. And and we're just in an observation. We're just observers. [1:29:04, 1:29:11]: We just listening to find out what could I could I what what the issues are. Could I suggest go ahead. [1:29:11, 1:29:14]: Uh I'm sorry, can I suggest that we record [1:29:15, 1:29:19]: Hoard the meeting and provide you all with the recording. [1:29:19, 1:29:39]: I would hate to put you all in a position as as that's why that's why I didn't invite you all to the meeting. Um, but we we can record the meeting, um, the Zoom meeting, um, and provide you all with that. If I guess if you want to attend, you can talk that with the with your legal counsel there. But we will definitely record it and can provide you with that recording. Okay. Mr. Williams. [1:29:39, 1:29:43]: What I would think would be in order for us to make a an informed decision [1:29:44, 1:29:50]: Not participating, just listening to what the community is saying, because there's been a lot of response to this project. [1:29:50, 1:29:57]: And I would hate to think that the community think that we're overriding them and that there are other people in the community [1:29:58, 1:30:03]: Trying to influence us one way or the other, and we're accepting that. I'd rather hear from the community. I'm not participating in it. [1:30:04, 1:30:18]: Just hearing from the community what their concerns are and can they be addressed. I understand we're not trying to cure all interest and concern, but we're trying to make an informed decision and make sure that we are addressing some of the concerns of the community without killing the project. [1:30:19, 1:30:39]: And I believe that this board, members of this board should be able to attend this meeting as pure observers. No, no opinions, no, no feedback from us at all. We're just there to listen and and hear the community um concerns. Or if you know, if they don't have concerns, let's hear those as well. [1:30:39, 1:30:58]: well, but I think that it would be best for not for a recording, but for us to be there to hear for ourselves, which I understand that, you know, we don't want to cross any uh legal lines, but I think it would be better that we were actually there. [1:30:58, 1:31:18]: In observation of this, and this would work out better. It would actually show our community that we are definitely working for them. And as I stated earlier in this meeting, um Count Councilman Alexander approached me with his personal opinions about this project. [1:31:18, 1:31:38]: project without without us even receiving any information of of what was proposed. So we want the community to know that we are working for them and the city of Stockbridge and that then the interest of our citizens comes before anything. So if if the council would, you know, if the uh city [1:31:38, 1:31:58]: manager and um attorney will allow us to just be observers then um that would sit well and if there's a limited amount of the board members that you actually want to be in attendance then let us work that out as well because we don't want to say there's a quorum and and we made an opinion there at at this particular community. [1:31:58, 1:31:59]: [5519.8, 5522.7]: So we're just we're just asking for permission. [1:32:03, 1:32:11]: Well, I I hear you loud and clear. I guess where I was going on that is uh, you know, the public hearing requirement is really meant to be. [1:32:11, 1:32:14]: your opportunity to hear from the public. [1:32:14, 1:32:15]: And [1:32:15, 1:32:18]: If you wanted to have a special date for that. [1:32:19, 1:32:24]: Um that community meeting could in fact end up being your public hearing. [1:32:25, 1:32:29]: And so you could advertise it as such and still continue the hearing over to your actual [1:32:30, 1:32:31]: Decision date. [1:32:31, 1:32:36]: Um on the uh on the twenty eighth. And so that that was my point. So you wouldn't [1:32:36, 1:32:39]: have a community meeting and then have another [1:32:40, 1:32:41]: During where you would hear [1:32:41, 1:32:44]: much of the same thing that you would have already heard in the community meeting. [1:32:45, 1:32:46]: What would be your recommendation? [1:32:47, 1:33:00]: Well, uh you know, my thought process is that go ahead and and you know, utilize that date for the public meeting, the community meeting as your public hearing. And that would be my recommendation so you don't [1:33:00, 1:33:04]: have essentially you know two long meetings um [1:33:05, 1:33:07]: You could just condense that to one. [1:33:08, 1:33:12]: And so what you're suggesting is that we table this, have a community meet, and then make our decision. [1:33:13, 1:33:20]: Yes, sir. I mean that again that's I mean otherwise, but for the COVID, we'd have all these people in in in council chambers anyway. [1:33:21, 1:33:35]: So what I'm going to move again is that we table this matter, have the community meeting, and we'll make our decision following the net. We'll just that'll just be our public hearing as uh a component of the meeting. [1:33:36, 1:33:56]: May I say one thing is that w we may have other cases on January twenty eighth that the for the planning commission to hear at at their regular meeting. So we can't just make this one case be the meeting when when we may have other cases to be heard as well. Nobody's on that. Nobody's suggesting that at all. [1:33:57, 1:34:02]: Okay, let me let me that's not what I understand the suggestion to be made is being made. [1:34:03, 1:34:14]: I think Mr. Knighton has a question on the Mr. Knighton. Yes, sir. Thank you. Thank you, Mr. Chair. I just wanted to make clarification. I believe the planning commission meeting in January is actually on the twenty first. [1:34:15, 1:34:18]: twenty first. [1:34:19, 1:34:22]: Okay. I wanna just make sure that the third that third [1:34:22, 1:34:26]: Thursday the twenty first. Be that as it may, we want to make sure that's clarified and clear. [1:34:26, 1:34:30]: The fourth Thursday, January twenty eighth. The fourth Thursday. [1:34:31, 1:34:31]: Okay. [1:34:34, 1:34:54]: Um the only thing I would have to um comment with regards to the public meeting. Um I I would want to make sure that at the meeting all of the um residents not only have an opportunity to talk, but that we as the developer have an opportunity to respond um to the questions. [1:34:54, 1:35:10]: and that there's kind of a free flow of information back and forth. And my only concern would be in a formal public hearing setting, we wouldn't really have that ability to have that um free flow. Um I I am certainly comfortable [1:35:11, 1:35:31]: with the idea of having two meetings. Um, I understand that you all want to participate in that meeting. Um, and it sounded like maybe a couple of you all could come. I mean, that that's for you all to work out. I'm not your legal counsel, so it doesn't matter in a sense to me from that perspective if your legal counsel [1:35:31, 1:35:34]: Council says that you all can all attend and just not say anything. [1:35:34, 1:35:54]: You know, that that's up to how you all deal with that. Um, but we would like um to be able to um hold a meeting so that, you know, in our at least when I hold my community meetings, I do try to let the community a ask as many questions. We can make it a one and a half hour meeting, uh two hour meeting, and then that way everybody can [1:35:54, 1:36:06]: definitely um you know have their questions and raise their issues and we try and address them. But that I obviously this is a decision you all need to make. Well that is that would be our preference. [1:36:06, 1:36:17]: That is the whole purpose of having that community meeting so that you can answer and address their concerns and uh we can make an informed decision. That's is and in fact what that's going to be [1:36:18, 1:36:20]: Is a continuation of this meeting. [1:36:20, 1:36:30]: only the public aspect of it. Ordinarily we would have the case that the the staff would present their case, the applicant would would present his case, and then the public comment. [1:36:30, 1:36:33]: We're not able to have comments today because of COVID. [1:36:34, 1:36:38]: And so what I'm suggesting because of the magnitude of this, let's have this meeting. [1:36:38, 1:36:39]: Let's [1:36:40, 1:37:00]: have the comments from the community. You can dress them as best you can and we can resolve as many as we possibly can and get on with this. It's not that we're trying to hold up the project, but we want to make it a decision that's going to be beneficial to both the community, the city and the citizens. Period. Okay. Well I'm not w I'm not afraid of having any kind of meaning. I [1:37:00, 1:37:20]: I see in the chat. I'm not afraid to hear what comments are and try and address the comments. Um, I just want to make sure that we all have an opportunity to to to speak and make sure that we have a opportunity to answer any questions that may come up. So however you all choose to do the meeting, I will show up with my team. [1:37:20, 1:37:31]: Well, it's gonna be up to you to set the meeting date. So from that point on, we'll uh it notifies we'll it will be in attendance. That'll be our public comment aspect and we can go from there. [1:37:32, 1:37:45]: Okay. So you want me to set up the meeting. Yes. Notify you all of the meeting date and then you all will act accordingly. Exactly. Okay. That's fine. That would be our p public uh comment uh portion of the meeting. Okay. [1:37:47, 1:37:48]: Any other questions? [1:37:53, 1:37:54]: Linda, do you have any additional comments? [1:37:55, 1:37:56]: Not at this time. [1:37:58, 1:38:00]: I believe Miss Nelson, um [1:38:01, 1:38:03]: Ms. Ms Nelson, did you have a comment? [1:38:05, 1:38:06]: Oh man. [1:38:09, 1:38:12]: Hearing none, I move that we table this matter until uh [1:38:13, 1:38:18]: Miss Battle notifies us of the uh meeting in which we can have public comment. [1:38:20, 1:38:22]: I will second that motion to [1:38:23, 1:38:26]: Hold off on this partic on the findings of this meeting until [1:38:27, 1:38:30]: The public notice had public meeting has been held. [1:38:31, 1:38:37]: Well the board can have a full jest. [1:38:37, 1:38:46]: Aye. Aye. Those opposed, the ayes have it. The motion is carried. The matter is tabled until the uh public comment meeting uh to be established by Miss Battle. [1:38:48, 1:38:49]: Linda? [1:38:50, 1:38:51]: Yes. [1:38:53, 1:38:54]: Next item. [1:38:56, 1:38:56]: Okay. [1:39:00, 1:39:01]: Let's see. [1:39:01, 1:39:09]: Number three, zoning modification zoning modification case. Number ZM 2020. [1:39:10, 1:39:14]: Rick Martin of Poulty Group and Poulty Georgia Holmes Division. [1:39:14, 1:39:19]: Request a zoning modification for the purpose of modifying the previously approved [1:39:20, 1:39:28]: 1996 development agreement and master plan for the former Aberdeen Village slash Brentwood subdivision. [1:39:28, 1:39:36]: To allow for the construction of a residential development containing single family detached and single family attached units. [1:39:36, 1:39:42]: Properties located in land lots twenty five, forty, and forty one of District Twelve within the Stockbridge. [1:39:42, 1:39:43]: City limits. [1:39:44, 1:39:45]: With frontage on the north side. [1:39:46, 1:39:50]: Of Walt Stevens Road between Spear Road and Brentwood Parkway. [1:39:50, 1:40:00]: It contains 155.2 plus or minus acres and is identified as parcel number 013 hyphen 01019000. [1:40:04, 1:40:05]: Mr Chair. [1:40:08, 1:40:09]: This is Randy Knighton, Mr. Chairman. [1:40:16, 1:40:19]: Yes, sir. Yes, thank you, ma'am. Um [1:40:20, 1:40:22]: I think you were finished, is that right, Linda? Were you complete? [1:40:25, 1:40:26]: Yes, Mr Chair. [1:40:26, 1:40:27]: Yeah. [1:40:27, 1:40:28]: Linda. [1:40:28, 1:40:29]: Yes. [1:40:29, 1:40:30]: Were you finished? [1:40:30, 1:40:31]: Yes. [1:40:31, 1:40:32]: Okay. [1:40:33, 1:40:34]: Mr. Knighton. [1:40:34, 1:40:37]: Yes, thank you, Mr. Chair. I wanted to mention to you [1:40:38, 1:40:42]: And and some of this is probably borne out in some of the correspondence you received. [1:40:42, 1:40:44]: W s with respect to this proposal. [1:40:45, 1:40:48]: Uh seemingly that there it's a fairly complicated [1:40:48, 1:40:55]: matter going back uh even to the mid nineteen nineties on this this particular proposal. And there are a number of things that [1:40:55, 1:41:01]: seemingly were revealed even in the last couple of days, that gave me some pause with respect to [1:41:02, 1:41:06]: Um, in fairness to uh the planning комісі, to the applicant, to citizens, to staff. [1:41:07, 1:41:09]: Be able to look at some of these things more closely. [1:41:10, 1:41:14]: I did uh contact and Linda has been in contact with uh Mr. Martin. [1:41:15, 1:41:19]: Uh over the past c uh several weeks. And I I did reach out to Mr. Martin. [1:41:19, 1:41:22]: um earlier today and race, you know, those concerns. [1:41:23, 1:41:25]: uh to him with respect to this proposal. [1:41:26, 1:41:27]: And [1:41:27, 1:41:29]: Asked about uh consideration [1:41:30, 1:41:34]: Of tabling this particular item for the items that I just enumerated. [1:41:35, 1:41:37]: I believe Mr. Martin is [1:41:37, 1:41:38]: Um [1:41:38, 1:41:42]: The applicant is I think I saw where he was raising his hand. I believe he's in [1:41:43, 1:41:44]: The forum somewhere. [1:41:45, 1:41:46]: Um to [1:41:47, 1:41:51]: To speak to the matter about perhaps um a request to table. [1:41:52, 1:41:54]: I wanted to provide that information to you, sir. [1:41:55, 1:41:56]: If I [1:41:57, 1:41:57]: I'm sorry. [1:41:58, 1:42:04]: No, no. Uh I'm just saying I I've read those correspondence that uh that you've issued uh and the um [1:42:06, 1:42:10]: complications of this matter we're dating back uh ninety five ninety six. [1:42:11, 1:42:15]: And so I understand that. That's the only thing I was saying. [1:42:15, 1:42:23]: Okay, thank you, sir. I don't know if the IT support can identify Mr. I believe it was Mr. Martin. I believe I saw where he had his Rick Martin. Hand his hand raised. [1:42:23, 1:42:25]: Oh there I see it now. I see it. [1:42:26, 1:42:46]: I'm a suggestion, Mr. Mark. Uh Mr. Chairman, I am here uh and and agree with Mr. Knighton. It would probably in the interest of uh clarity and understanding the scope of what we're trying to accomplish, I think it's a good idea to table this for the time being. We'll meet with staff and Mr. Knighton as they see fit and try to um [1:42:46, 1:42:51]: work through all the issues and and reschedule another another night. [1:42:53, 1:43:02]: Okay. Um I get a motion to table uh item number 2020 ZM 2020 oh one. [1:43:02, 1:43:04]: Does we have a time frame? [1:43:04, 1:43:05]: Pardon me? [1:43:07, 1:43:09]: Do they have a time frame they'd like us to table it for? [1:43:11, 1:43:16]: Mr. Knighton? Yes, sir. I would assume it would be the next planning commission meeting in January. [1:43:17, 1:43:18]: Okay. [1:43:19, 1:43:21]: So that would be the twenty eighth of January twenty eighth. [1:43:23, 1:43:26]: Well, I motion to table this one until January twenty eighth. [1:43:27, 1:43:28]: Document. And last second. [1:43:29, 1:43:31]: Who's second who who who's the second? Harold. [1:43:32, 1:43:33]: Harold Sibado. [1:43:33, 1:43:39]: All right, it's been moved and second. All those in favor, let it be known by the sign of I. I agree. [1:43:39, 1:43:40]: Those opposed. [1:43:41, 1:43:48]: The as have the motion is carried the matters table to the next planning commission meeting, which is January twenty eighth, two thousand twenty one. [1:43:51, 1:43:52]: Uh [1:43:55, 1:43:56]: Any board comments? [1:43:59, 1:44:01]: Any board comment, further comments. [1:44:03, 1:44:05]: Hearing none, now I have a motion to adjourn the meeting. [1:44:07, 1:44:10]: Mr. Chairman, I move that this meeting be adjoined. [1:44:11, 1:44:13]: I'll second the meeting enjoyment. [1:44:14, 1:44:17]: All right, it's been moved and seconded. All those in favor let it be known by the sign of a [1:44:18, 1:44:26]: I agree. Those opposed? Aye serve. The motion is carried. The meeting is adjourned. We'll meet again January 28, 2021. [1:44:27, 1:44:28]: With all of you good health. [1:44:29, 1:44:38]: Thank you. And thank you, Planning Commissioners, for the service you provide to the city of Stockburn. Thank you. And Merry Christmas to Happy Holidays to all. [1:44:39, 1:44:41]: Thank you. Good night. Good night.
