[0:37:06, 0:37:07]: And others more recent. [0:37:07, 0:37:13]: The fact of the matter is, with each conversation that I have had with the council members for the city of Stockbridge, [0:37:13, 0:37:15]: You have either stated yes, I agree. [0:37:15, 0:37:17]: Or it was never brought to your attention to vote. [0:37:18, 0:37:21]: Or the mayor or Mr. Knighton mentioned the standard practices. [0:37:21, 0:37:22]: Which I have mentioned above. [0:37:22, 0:37:25]: That are not always the best practices and [0:37:25, 0:37:26]: Every situation. [0:37:26, 0:37:28]: At this point I am really confused. [0:37:29, 0:37:38]: As it was brought to my attention that this matter was polled to each and every council member by Mr. Knighton for consensus, but he did not receive a majority vote. [0:37:38, 0:37:44]: So I am requesting that you all vote tonight and express your thoughts publicly so that I and the citizens. [0:37:44, 0:37:47]: are very clear on each of your responses. [0:37:47, 0:37:51]: In closing, I am very much aware the plaque has been completed. [0:37:51, 0:37:52]: However [0:37:52, 0:37:55]: Please note that a name can be added at any time. [0:38:43, 0:38:46]: A wall will only make it worse, in my opinion. [0:38:47, 0:38:48]: We need a sound. [0:38:49, 0:38:51]: Experts for audio mitigation. [0:38:52, 0:38:56]: Please research hertz level, not just decibels. [0:38:56, 0:38:59]: And nowhere as expensive as a wall. [0:39:00, 0:39:02]: Why was this not in the design? [0:39:02, 0:39:06]: Our neighborhood has endured two years of food truck Tuesdays. [0:39:07, 0:39:08]: Also the test concert. [0:39:09, 0:39:10]: Hurt a flippin' robe. [0:39:10, 0:39:12]: And way down Old Conyers Road. [0:39:13, 0:39:16]: I personally have been asking for this mitigation. [0:39:16, 0:39:18]: since march twenty nineteen. [0:39:19, 0:39:21]: When our concerts got basically blown off. [0:39:23, 0:39:29]: Time and time, I'm sorry, when our concerts apologize, when our con concerns got basically bone blown off. [0:39:30, 0:39:32]: Time and time again. [0:39:32, 0:39:36]: For two and a half years, I have asked you to address this situation. [0:39:36, 0:39:40]: I am offended that anyone would install wrought iron [0:39:41, 0:39:45]: And small bushes as a solution and to put the funding [0:39:45, 0:39:46]: For it. [0:39:46, 0:39:49]: On a fantasy T Splash. [0:39:49, 0:39:51]: that hasn't even been voted on yet. [0:39:52, 0:39:53]: It's just mind blowing. [0:39:54, 0:39:56]: This is a problem city council. [0:39:57, 0:40:00]: We have already endured almost two years of [0:40:00, 0:40:01]: Earth shaking. [0:40:01, 0:40:03]: Constant beeping. [0:40:03, 0:40:04]: BMA. [0:40:05, 0:40:06]: And the cops called on us. [0:40:07, 0:40:09]: by the construction workers the city hired. [0:40:10, 0:40:13]: Now we expected to pay a brand new city tax to pay for it. [0:40:14, 0:40:15]: No way is the new city tax. [0:40:17, 0:40:20]: No way is the new city tax for the new PD. [0:40:21, 0:40:23]: How is that possible? [0:40:23, 0:40:26]: When we just blew twenty three million dollars. [0:40:26, 0:40:28]: On an amphitheater. [0:40:28, 0:40:29]: Eight million dollars. [0:40:30, 0:40:30]: Over budget. [0:40:31, 0:40:32]: Something is not right here. [0:40:33, 0:40:34]: We all know it. [0:40:35, 0:40:37]: Don't put us off anymore. [0:40:37, 0:40:38]: Mr. Mayor. [0:40:39, 0:40:40]: We need answers now. [0:40:41, 0:40:42]: And in my opinion. [0:40:42, 0:40:45]: We are not ready to open that place. [0:40:45, 0:40:48]: Mr. Alexander posted on BWC. [0:40:49, 0:40:53]: That people could park at Moy's Food Depot, Stockbridge Baptist Church. [0:40:54, 0:40:58]: Sadie Hawkins School, Subway, etcetera. [0:40:58, 0:41:01]: Did he ask their permission to post this? [0:41:01, 0:41:06]: Because the church has gated their parking lot now for the first time in fifty years. [0:41:07, 0:41:09]: The residents can't even cut through. [0:41:11, 0:41:12]: To the subway now. [0:41:13, 0:41:15]: Half of my family learned [0:41:15, 0:41:18]: to drive in that parking lot. Now it's sad. [0:41:19, 0:41:21]: Anyway, I predict the parking [0:41:21, 0:41:24]: thing and the traffic will be a disaster on the twenty fifth. [0:41:24, 0:41:27]: And the amphitheatre is not even on the agenda. [0:41:27, 0:41:31]: Even though we will soon be swarming with people all over town. [0:41:32, 0:41:35]: How long should we quarantine after the concert? [0:41:35, 0:41:39]: What if one of those forty two hundred gets sick or injured? [0:41:40, 0:41:41]: Or have an altercation. [0:41:41, 0:41:43]: The hospital is diverted. [0:41:43, 0:41:45]: They have closed most schools, like [0:41:46, 0:41:49]: Mr. Blount and Miss Gantt said we jumped the gun. [0:41:49, 0:41:50]: We are not ready. [0:41:50, 0:41:51]: But now that's [0:41:51, 0:41:53]: It sold out. [0:41:53, 0:41:56]: Shouldn't y'all be discussing how to handle the crowd? [0:41:56, 0:41:58]: Our quarantine, I don't care. [0:41:58, 0:42:01]: Just please give us noise mitigation. [0:42:01, 0:42:04]: We want to stop the suffering. Thank you. [0:42:05, 0:42:07]: Mayor, there are no further comments. [0:42:07, 0:42:27]: All right. Well there's obviously several different things that uh comments there that uh need to be answered in in this aspect. And some things uh that were mentioned uh were not really uh really not uh accurate, I would say, in this aspect. So we gotta look at a way to uh get back to those individuals and to answer those particular questions in this aspect. So [0:42:27, 0:42:47]: um on that note. I know that we've it's recording and we have uh documentation of this and we'll have to make some concerted effort to to respond to those things uh appropriately in this time. Uh on that note, unless there's any other uh discussion on this any of these issues, I'd like to move on to old business. [0:42:47, 0:42:55]: No, that we added the old business in reference to the municipal precincts uh to the um uh to the agenda. Ms. Johnson, please. [0:43:05, 0:43:08]: Good evening, Mayor, Council members and residents. [0:43:08, 0:43:11]: So yes, um we have a [0:43:11, 0:43:13]: Um a precinct map. [0:43:13, 0:43:32]: uh which has been um revised based on the 2020 census numbers for our population in an effort to balance out and get an average of residents that will be within each precinct uh we've created the um the map I'm gonna show you on my screen. [0:43:33, 0:43:34]: A moment. [0:43:36, 0:43:39]: Okay, can you all see this? Let me make it a little larger. [0:43:40, 0:43:41]: Yeah, we can see it now. [0:43:43, 0:43:46]: Uh I can make it a little bit larger so you can kind of see what's going on. [0:43:47, 0:44:02]: So if you will know there are three different colors on the map, each of which um denotes a different precinct. We have three precincts within the city. Umriginally the populations were, you know, we had 15,000 on the first one. [0:44:02, 0:44:12]: 7,000 on the next one and 9,000 on the last one. So in an effort to kind of balance out our um averages based on the current census. [0:44:12, 0:44:17]: We have redrawn some of the lines. So the city's been working with the um [0:44:18, 0:44:21]: With the board of um elections. [0:44:21, 0:44:25]: to um come up with this map and um [0:44:25, 0:44:29]: And the GIS folks at Henry County um help us. [0:44:29, 0:44:32]: Pull this map together based on the council's wishes. [0:44:32, 0:44:35]: So what we have here are [0:44:35, 0:44:38]: Um there was originally only one. [0:44:38, 0:44:40]: Location to vote. [0:44:41, 0:44:43]: On the day to vote. [0:44:43, 0:44:45]: Um on voting day. [0:44:45, 0:44:47]: And that was Merrill Manders. [0:44:47, 0:45:07]: Uh what has happened is we've added two more locations, um, Red Oak United Methodist Church and Stockbridge First United Methodist Church, which all will be available on voting day. Now, of course, during early voting, all the other um voting locations throughout the county will be available. [0:45:07, 0:45:12]: For residents. So we have just made some adjustments to the map in this regard. [0:45:13, 0:45:17]: Um I uh according to what I understand from um [0:45:18, 0:45:20]: from s staff is that [0:45:21, 0:45:25]: Uh we increased the number because we were having kind of low voter turnout. [0:45:25, 0:45:33]: on the day of people from way up in McDonough were having to come all the way down to Stockbridge and it was causing some issues there. So [0:45:34, 0:45:37]: These other two precincts will kind of help in aiding. [0:45:37, 0:45:40]: Um having an addition additional locations for [0:45:41, 0:45:45]: Um for voting on the day to vote, the Tuesday. [0:45:46, 0:45:51]: Um, that's kind of all of it I have to kind of go over. So if you have any questions, uh please let me know. [0:45:53, 0:45:55]: Uh Mayor. Yeah, go right ahead, please, Mayor Portan. [0:45:56, 0:46:05]: Yeah, I just want every citizen watching to understand that voting is important in the city and to understand we have been working diligently. [0:46:05, 0:46:07]: Because I remember [0:46:07, 0:46:09]: In the last election cycle. [0:46:09, 0:46:12]: Where we had hundreds of voters. [0:46:12, 0:46:13]: In line. [0:46:14, 0:46:15]: The municipal cor. [0:46:16, 0:46:19]: At seven o'clock with only one voting location. [0:46:20, 0:46:23]: This is significant history for the city of Stockbridge. [0:46:24, 0:46:27]: In that we will have multiple polling locations. [0:46:27, 0:46:34]: Because in in itself, waiting in line an extended amount of time is voter suppression. [0:46:35, 0:46:43]: When you're in power and you have something that you have uh the power to do something about voter suppression and discouraging people from voting. [0:46:43, 0:46:52]: You do that. Now that we have three separate voting precincts, folks won't have to wait in line uh on election day like they did. [0:46:53, 0:47:03]: Still, it is better to vote on early voting where you don't have to wait in line at all. And most times you can walk into the location at the early voting location. [0:47:03, 0:47:04]: And be able to vote. [0:47:05, 0:47:05]: Early. [0:47:06, 0:47:08]: And then not have to wait in line on election day. [0:47:09, 0:47:12]: It's extremely important this year because if you vote [0:47:12, 0:47:18]: uh early during early voting, you can vote for T Splos and you can also vote at the same location. [0:47:18, 0:47:31]: And then uh on this map, like at this location where Red Oak is, uh it's a county polling place there at Red Oak. So at that location, you can you will be able to vote. [0:47:31, 0:47:33]: Uh on election day you'll be able to vote. [0:47:34, 0:47:47]: for uh the may the uh city council and mayoral election and the T Splash at one location. I think the desire for us all is to, as uh the 2020 census is done. [0:47:47, 0:47:53]: And we uh have uh more understanding of the population spread. [0:47:53, 0:48:01]: That we will have more voting precincts in the south side of Stock Bridge as well. The only reason that we did not have. [0:48:02, 0:48:05]: Uh any locations in the south part of Stockbridge. [0:48:06, 0:48:08]: Uh in the Eagles Landing area. [0:48:08, 0:48:21]: uh at uh a part of stock bridge and i and i want to let me say this when i say eagles landing i'm talking about stock bridge so let's stop that right now let's say that part of the city there were no polling places [0:48:21, 0:48:32]: that were inside the city limits in that area. So we could not add any polling places in there. But going forward, we will work with the county. [0:48:32, 0:48:34]: Uh to be able to have [0:48:34, 0:48:52]: uh a polling location in that area inside the city limits. The law requires that we have uh that the all city elections are located inside the city limits. The tabernacle of praise, that's not in the city limits. [0:48:52, 0:49:12]: That wasn't what we looked at. The Flippin Elementary School location that I that was moved uh I think to Jodico First Baptist. That location was not in the city limits. Pate's Creek is not in the city limits. So all of the polling locations on the south side of the city, none of those locations were in the city limits. [0:49:12, 0:49:21]: City limits. So we were not able to add a precinct down there. That's something that we're going to uh work on in the future to make sure that we get that done. [0:49:21, 0:49:32]: But please understand the effort is ongoing and that this is significant. That is the first time in the history of the city of Stockbridge that you'll have multiple places to vote. [0:49:32, 0:49:41]: Uh, on election day. And I thank the mayor, the council. And I specifically want to thank Miss Vanessa Holliday. She is brilliant, y'all. [0:49:41, 0:49:42]: Okay. [0:49:42, 0:49:44]: And uh Mr. Kirk. [0:49:44, 0:49:47]: Who and Miss uh Johnson who who worked uh [0:49:47, 0:49:53]: tireless hours to be able to break this down to make sure that each polling plug place was um [0:49:54, 0:50:02]: balanced as possible as much as they possibly could. So thank you and kudos to you for uh making it easier for folks to vote in Stockbridge. [0:50:04, 0:50:06]: Council, any further comments at all? [0:50:06, 0:50:07]: Um [0:50:07, 0:50:15]: I do realize that we do have members of the Mayor. Yes, ma'am. Go right ahead, please. I I'm sorry, I raised my hand. Um go right ahead, please. [0:50:16, 0:50:18]: Um, thank you. I just wanted to make sure [0:50:19, 0:50:22]: Ken the last time we voted on this, it was only [0:50:23, 0:50:24]: I think we all agreed. [0:50:25, 0:50:30]: two precincts so long as it was within budget. Do we know the budget at this point? [0:50:31, 0:50:51]: Mayor. Yeah, go right here. Stand by, please. Um, Miss Holiday, uh have we got confirmation of that? And I know we have members of the uh Henry County Board of Elections online as well that can potentially uh assist us with this uh particular question. That's this concern. Is Amika able to join? She was having She's online. She's here. Okay, good. Yes. [0:50:51, 0:50:54]: Yes, we um they did come in under budget. [0:50:55, 0:50:57]: Um, but if she wants to speak to that. [0:50:58, 0:51:01]: Ms. Pitts, go right in the page. Yeah, Miss Pitts, go right in, please. [0:51:01, 0:51:02]: Yes, good evening. [0:51:03, 0:51:04]: Um [0:51:04, 0:51:09]: First of all, I just want to apologize about the last meeting, and I'm glad to be able to be here tonight. [0:51:09, 0:51:19]: Um I did some calculations and also me and my team we did some assessment and we were able to be able to accommodate this request without getting new machines. [0:51:19, 0:51:30]: And so I went back and revised the invoice and it is just a projection we were able to possibly pull off the election for$21,993. [0:51:31, 0:51:32]: Could you repeat that cost again, please, man? [0:51:33, 0:51:37]: Yes, sir, twenty-one thousand nine hundred and ninety-three dollars. [0:51:38, 0:51:38]: Okay. [0:51:40, 0:51:44]: And that it obviously was in our parti Miss Holiday spent our our projected budget. Is that correct? [0:51:45, 0:51:46]: Yeah, that's correct. [0:51:46, 0:52:05]: Okay, thank you. So so thank you for that. Um actually that's excellent. If that is the case, if we can get it under the twenty-five thousand dollar budget and have more precincts, I hope that we can mo I hope that other cities and other municipalities and as well as our county will be able to mimic. [0:52:05, 0:52:20]: that at some point. Um, I think that's important. So that's excellent. So long as we're in budget, I'm for it. I wasn't for it until I knew the budget and that we were under that we were, you know, weren't spending extra money, but I'm I'm all for it. So thank you. [0:52:21, 0:52:24]: Ms. Ms. Pitts, do you have anything else you'd like to add at this time? [0:52:24, 0:52:39]: Yes, I did want to add again that this is a projection. Um sometimes we have to have additional poll workers or additional riders, um, but from what you're saying, I can't see it going too far past 25 if it does um increase. [0:52:41, 0:52:42]: That's all I have to say. Thank you. [0:52:42, 0:52:49]: Thank you, ma'am. Um council, any other council thank you, ma'am. Um any other council members, any comments at all? [0:52:51, 0:52:54]: Um I have the county com uh [0:52:55, 0:52:58]: Manager online, Miss Matthews, anything you need to add at all, ma'am? [0:52:59, 0:53:01]: No, sir, Mayor Um Ford. Thank you. [0:53:01, 0:53:10]: Okay. Yes sir. Go right ahead, please. If we could and I know this is a lot, but Miss Holliday, you you're just so brilliant. I know you can do it. I bet. [0:53:11, 0:53:23]: In different parts of the city and like area one, two, three, uh two and three, give the voters an example of where they would be voting at for for like in the two in the in the areas. [0:53:24, 0:53:30]: Okay, if you are if you see the peach area, which is precinct one. [0:53:30, 0:53:32]: That's the Merrill Manders Conference Center. [0:53:33, 0:53:34]: The pink [0:53:34, 0:53:35]: Area. [0:53:36, 0:53:37]: Which is precinct. [0:53:37, 0:53:38]: Two [0:53:38, 0:53:41]: That's the Stockbridge First United Methodist Church. [0:53:42, 0:53:45]: And the blue area, which is precinct three. [0:53:45, 0:53:48]: It's Red Oak United Methodist Church. [0:53:49, 0:53:52]: This is an election day map. [0:53:55, 0:54:00]: Which is the thing that's just a good clear. Which means if you were to go to any one of those precincts. [0:54:00, 0:54:02]: Uh and vote on election day. [0:54:03, 0:54:07]: Uh, you will be voting at one of these three for city elections. [0:54:08, 0:54:09]: If, however [0:54:11, 0:54:12]: Precinct one. [0:54:12, 0:54:16]: which is the Merrmanis Conference Center, is your normal [0:54:17, 0:54:21]: County polling location, you would also be able to vote for SPLOS. [0:54:21, 0:54:25]: Likewise for Stockbridge First United Methodist Church. [0:54:25, 0:54:26]: If that is your normal [0:54:26, 0:54:28]: County Poland Location. [0:54:28, 0:54:32]: And you vote on your city election on election day, you will also be able to vote. [0:54:33, 0:54:35]: Courseplas, likewise with red oak. [0:54:36, 0:54:38]: If that is your normal polling location. [0:54:39, 0:54:42]: On election day, you will be able to vote for your mayor and council. [0:54:42, 0:54:42]: And [0:54:43, 0:54:43]: A T splas. [0:54:44, 0:54:44]: County. [0:54:45, 0:54:45]: Ballot item. [0:54:48, 0:54:50]: Thank you. So your question being pro camp. [0:54:51, 0:54:53]: Yes, thank you. Great explanation. [0:54:55, 0:54:55]: Yeah. [0:54:57, 0:55:01]: All right, council, any other questions or concerns before we move on to the next subject? Anybody else? [0:55:03, 0:55:05]: And I do not see any others. [0:55:06, 0:55:14]: Okay. On that note, appreciate it. Thank you, uh Miss Johnson. Um you can appreciate it. [0:55:15, 0:55:18]: Mayor. Yes, ma'am. The map will require a vote. [0:55:20, 0:55:21]: Thank you very much. [0:55:21, 0:55:22]: Thank you. [0:55:22, 0:55:26]: So moved, I approved the map. I would like to make a motion. [0:55:26, 0:55:29]: To approve the map as presented by [0:55:29, 0:55:42]: um staff with the three voting precincts for the city of Stockbridge. So Miss Barber was first on that. Second, any further discussion? If not, uh everybody please indicate. [0:55:43, 0:55:50]: Is that uh I would imagine that's a unanimous decision. I can't see everybody right now, but it looks like it'd be a unanimous decision on that. [0:55:50, 0:55:51]: Okay. [0:55:52, 0:56:03]: Thank you very much. Thank you, Ms. Holland. All right. Good deal. Thank you. Oh Mayor Mayor Fred. I'm sorry. My connection is kind of spotty. So just in case if I freeze. [0:56:04, 0:56:08]: You give me just a second to kind of regroup. That's all. Sure. No problem. [0:56:09, 0:56:09]: Thank you. [0:56:10, 0:56:12]: Thank you, Ms. Holiday, Ms. Johnson. We appreciate your efforts. [0:56:13, 0:56:26]: Great work. Thank you very much. Thank you everyone. Ms. Pitts, thank you. Um also uh Ms. Uh Matthews, appreciate you being here. You can stay as long as you like as well. But thank you for all your efforts uh from the office. Yes, ma'am. [0:56:26, 0:56:31]: Uh Chair Harrell is not on the call, but she was instrumental and I wanted to thank her as well. [0:56:32, 0:56:42]: Absolutely. Our chair is key to to all happen making this all. Absolutely. Thank you. Sorry. Thank you for catching that. Thank you very much. And we we appreciate Chair Harrell as well. [0:56:42, 0:57:00]: Um absolute okay. On that note, uh we're gonna move on to our next item, uh new business council consideration approved task order 28.1 with Carter and Sloop, Pine View Lyft Station Rehabilitation and Water Wave Force uh Maine and amount of [0:57:01, 0:57:10]: Forty eight thousand one hundred dollars. The funny source is the sewer fund balance presented by Mr. Aaron and Mr. Holsinger, please, gentlemen. [0:57:11, 0:57:22]: Yes, Mr. Mayor. Thank you, Mayor and Council. I'll let Mr. Holt Singer speak to this project as this is a continuation of staff's moving forward with upgrading our sewer collection system. [0:57:23, 0:57:37]: Thank you, Mayor and Council, for hearing me. Um this list station is over in Pine View, the recently developed subdivision. It serves prior to the Pine View, it served Pine Grove. [0:57:38, 0:57:39]: And Pine Grove was under [0:57:40, 0:57:41]: was half developed for [0:57:42, 0:57:44]: Many, many years. I don't even know how many years it was. [0:57:45, 0:57:49]: So that new listation twenty plus years ago set [0:57:50, 0:58:05]: rarely used and believe it or not in sewer something rarely used is not good. So hydrogen sulfide has worn it out and it's it's 20 plus years old anyway, so it's really time. [0:58:06, 0:58:09]: But with the addition of Pine View, it it helps it a lot. [0:58:11, 0:58:13]: Okay, appreciate that. [0:58:13, 0:58:15]: Uh Mr. Aaron, do you have anything you need to add, sir? [0:58:16, 0:58:26]: Um one other thing is we've been working with Mr. Wiggins and this will be reimbursable under the ARPA fund, so it would not be sewer fund balance. [0:58:27, 0:58:28]: Fantastic. [0:58:28, 0:58:29]: Great, great point. [0:58:30, 0:58:32]: Council, any questions for these gentlemen at all? [0:58:32, 0:58:34]: Yes. Go right in, please. [0:58:36, 0:58:41]: Okay. So let me ask uh in terms of this, of course this was placed there twenty years ago. [0:58:42, 0:58:44]: Uh in a forward thinking way. [0:58:44, 0:58:46]: The city's gonna grow. [0:58:46, 0:58:49]: Now what we put there twenty years ago. [0:58:49, 0:58:50]: May not have been adequate. [0:58:51, 0:58:54]: So was there some consideration given to the fact that [0:58:55, 0:59:09]: In this area it might it might be need a a larger size or a bigger uh type of uh apparatus because uh of uh the growth coming to the city. So was there some [0:59:09, 0:59:14]: Uh is there i is it are e is that even a consideration with the with the uh [0:59:14, 0:59:16]: Uh with this replacement. [0:59:16, 0:59:24]: Yes, sir. All that's being considered, uh, the growth. We're look we're looking forward. We're not looking to present or or back. We're looking forward. [0:59:25, 0:59:34]: Okay, so in terms of how this machinery that we put in there twenty years ago, is there better technology available now in terms of what we're going to? [0:59:34, 0:59:36]: Yes, sir, absolutely. So I mean [0:59:37, 0:59:39]: A hundredfold better technology. [0:59:40, 0:59:43]: Okay. Well that that's that's reassuring. Thank you. [0:59:46, 0:59:47]: Any other questions, Council? [0:59:50, 0:59:52]: If not, I need a motion to accept this proposal, please. [0:59:54, 0:59:55]: Come on. [0:59:55, 0:59:56]: Ms. Barber Solmu. [0:59:57, 0:59:58]: This cat. [0:59:59, 0:59:59]: A second. [1:00:00, 1:00:03]: Ms. Can seconds. Okay. Any further discussion? [1:00:03, 1:00:05]: If not all in favor, please indicate. [1:00:06, 1:00:12]: Okay, it's unanimous decision. Appreciate it. Thank you. Thank you, Council. Thank you, Mr. Aaron, Mr. Holsinger. [1:00:12, 1:00:14]: Thank you, Mayor and Council. [1:00:14, 1:00:22]: Council consideration to modify the development agreement for the 438 East Atlanta Road condominium community, presented by Ms. Johnson, please. [1:00:24, 1:00:27]: Good evening, Mayor, Council members, once again. [1:00:27, 1:00:38]: So um on the 25th of May, you all heard the um request for the development agreement for some modifications um originally. [1:00:39, 1:00:42]: for a property that had been rezoned to RM3. [1:00:43, 1:00:45]: In two thousand three. [1:00:45, 1:00:47]: And what they wanted to do was come in. [1:00:48, 1:00:50]: Update the um [1:00:50, 1:00:52]: Development agreement in order for them to build out. [1:00:53, 1:00:57]: um this particular project of 202 condominiums. [1:00:58, 1:01:03]: What has happened is um during that process, and I'll share my screen so you all can see. [1:01:04, 1:01:06]: What has currently been approved? [1:01:09, 1:01:11]: Well this is the development agreement. [1:01:12, 1:01:15]: That was approved by the city council on the twenty-fifth. [1:01:16, 1:01:26]: And again, this project was uh rezoned and the development grade originally was done in 2003. So I'm just gonna scroll down to the [1:01:27, 1:01:28]: Section. [1:01:28, 1:01:30]: that we are speaking of specifically. [1:01:31, 1:01:33]: Which is under the amenities package. [1:01:34, 1:01:35]: What if the applicant um [1:01:36, 1:01:38]: originally had in the [1:01:40, 1:01:43]: In the development agreement was to have the clubhouse. [1:01:43, 1:01:48]: Junior size Olympic pool, playgrounds, waiting pool, pocket park and [1:01:49, 1:01:50]: Walking trails. [1:01:50, 1:01:54]: Um there was the what you see X Dow is tennis courts. [1:01:55, 1:02:00]: The applicant contends that they're not able to add in tennis courts due to the fact that. [1:02:01, 1:02:01]: They have [1:02:02, 1:02:06]: They already have the amenities laid out and based on the [1:02:06, 1:02:08]: Layout of the property. [1:02:08, 1:02:11]: They're they're unable to put in tennis courts. [1:02:11, 1:02:14]: Let me show you what was also approved. [1:02:14, 1:02:18]: Can you all see my screen? I don't know if you can see the site plan. Yes, can you all see that? [1:02:18, 1:02:19]: Okay, super. [1:02:20, 1:02:21]: So let me zoom in. [1:02:21, 1:02:22]: Just a little bit. [1:02:23, 1:02:29]: So along East Atlanta Road, these are buffers here, and these are the proposed amenities that stated earlier. [1:02:29, 1:02:30]: Um [1:02:31, 1:02:36]: Which includes you know the pool, waiting area, walking trails and throughout. [1:02:36, 1:02:42]: And that sort of thing. Uh I do have um Ms. Michelle Battle on the line. [1:02:42, 1:02:46]: Um staff doesn't have any objection to the adjustment as [1:02:47, 1:02:49]: Um the amenities in [1:02:49, 1:02:55]: that are already being proposed do appear appropriate for that size development. [1:02:55, 1:02:57]: But we do have Miss Uh [1:02:58, 1:03:01]: Michelle Battle on the line to you know add anything additional. [1:03:02, 1:03:05]: Welcome, Miss Battle. Uh anything else you need to add at this point, ma'am? [1:03:06, 1:03:20]: Yes, I'd like to add a little bit more um information. Um when we started this project out, the site plan that you see here um was what we presented to city council on May the 10th. [1:03:20, 1:03:30]: Um, at that meeting there was still some questions about the proposed conditions, and we were asked to defer that matter to the May twenty fifth meeting. [1:03:31, 1:03:38]: um to work with the county or sorry, the city attorney and staff to make sure that we had the conditions correct. [1:03:39, 1:03:43]: The conditions that we originally submitted that you all saw on May 10th. [1:03:43, 1:03:45]: Did not include [1:03:45, 1:03:46]: The tennis courts. [1:03:47, 1:03:53]: Um, that was an addition that was made subsequent between the May 10th meeting and the May 25th meeting. [1:03:54, 1:03:54]: That [1:03:55, 1:03:57]: additional provision was added by staff. [1:03:58, 1:03:59]: Um [1:04:00, 1:04:11]: It is our understanding, and and I you know, I have no reason uh it's not even about believing Miss Johnson. She sent an email. I never received the email, I never saw the email. [1:04:11, 1:04:15]: I'm not saying she didn't send the email because clearly she's given us a copy of it. [1:04:15, 1:04:16]: Um but I didn't [1:04:17, 1:04:23]: For whatever reason, I don't know if I accidentally deleted it. I'm not really sure. But the bottom line is I did not see that email. [1:04:23, 1:04:33]: Um and so she had the changes that had been made um to the agreement um within that. Now I had sent her one that had [1:04:33, 1:04:36]: modifications and red lines in it. [1:04:36, 1:04:40]: Um, she did not um see that in the package that I sent over to her. [1:04:40, 1:04:57]: So she did her own red line and then she also went back through, and I think appropriately the code to verify in information um and to make sure, you know, there were a couple of other little tweaks and changes that were made to the conditions. Um at the hearing on May 25th. [1:04:57, 1:04:58]: Um, there was no [1:04:59, 1:05:00]: discussion. [1:05:00, 1:05:02]: About the tennis courts. [1:05:02, 1:05:03]: Um [1:05:03, 1:05:08]: But we did show this site plan and it was conditioned on this site plan. [1:05:09, 1:05:23]: Which does not show the tennis courts. So if we could see the fullness of the site plan, we can't really see the whole thing. Um, Ms. Johnson, if you wouldn't mind um smalling it up a little bit, you will see um that. [1:05:23, 1:05:28]: Um, we don't have when we look at the bottom portion of the site. [1:05:28, 1:05:31]: Um, where the other amenity areas because we have two [1:05:32, 1:05:32]: Um [1:05:33, 1:05:50]: uh pocket parks, playground areas that you all requested. And then the back portion of the property as well the tr is where the trail is and is not um suitable because it's um uh more sensitive environmental areas in the back. So it's not suitable for a tennis court. [1:05:50, 1:05:51]: Um [1:05:51, 1:05:55]: DRB has found that quite honestly, tennis courts are [1:05:55, 1:05:57]: Um sommet old school. [1:05:58, 1:05:58]: Um [1:05:59, 1:06:03]: We have quite a bit of other amenities on this site. [1:06:03, 1:06:05]: I know that um [1:06:05, 1:06:11]: You know, certainly the USTA would love to continue to encourage people to put tennis courts in. [1:06:11, 1:06:13]: uh communities. [1:06:13, 1:06:16]: But the truth of the matter is they are expensive to maintain. [1:06:16, 1:06:18]: Um the HOA has to um [1:06:19, 1:06:25]: Provide the resurfacing for the tennis courts. Um, and if people are not using them on a regular basis. [1:06:25, 1:06:31]: then it's you know they end up turning into other things as opposed to people just playing tennis. [1:06:31, 1:06:51]: Um, if there were a place on here uh to actually put the tennis courts, um, we would certainly come back and and provide that. But there's really no place without um reducing the size and locations of the other amenities. And even with that, there just isn't a spot on here um for. [1:06:51, 1:07:02]: tennis courts. So we are respectfully requesting that the site plan that you all approved be upheld and that that additional condition of the tennis courts be removed. [1:07:03, 1:07:06]: Okay, thank you for that. Uh questions for the council. [1:07:06, 1:07:07]: Council. [1:07:07, 1:07:11]: Yes, sir. You go right here, Mayor Protein. Let me just say this right off the bat. [1:07:12, 1:07:14]: Now I'm gonna tell you how the tennis courts got in there. [1:07:15, 1:07:16]: We talked about [1:07:16, 1:07:22]: uh being consistent with what we had going on with um in our communities in stockridge. [1:07:22, 1:07:30]: My community has a tennis court. I think pretty much all of our communities have some type of facility that's interested. [1:07:30, 1:07:32]: in that in in in doing that. [1:07:33, 1:07:36]: I think we talked about uh the facilities that we were putting in. [1:07:37, 1:07:39]: Uh at Brandon Road and [1:07:39, 1:07:49]: and other areas and we wanted to be very uh consistent with what we had had going uh here uh in the city of Stockbridge. Now personally for me. [1:07:50, 1:07:56]: I'm sorry, Ms. Bowdo, I'm not voting to change the tennis court. If you want to sacrif you if you need to. [1:07:56, 1:07:59]: Uh move and remove a unit or so. [1:07:59, 1:08:14]: then that would be your prerogative. If you want to abandon the project, that's your prerogative. But in the end, what we're trying to do here is to be uh very consistent and have high quality neighborhoods with as many amenities as possible. [1:08:15, 1:08:16]: To move through. [1:08:16, 1:08:17]: Uh, this particular [1:08:18, 1:08:18]: Um [1:08:19, 1:08:20]: uh you know without zonings [1:08:21, 1:08:25]: We want to I'm I'm speaking for myself, I don't speak for everybody else. [1:08:25, 1:08:28]: But from from my standpoint, we're trying to set the standard. [1:08:28, 1:08:36]: for what we want to come to the city. And we want everybody to bring an a junior elephant size pool, a tennis court. [1:08:36, 1:08:40]: A clubhouse because we want every community to be [1:08:40, 1:08:43]: of a quality community and sending that message out. [1:08:44, 1:08:44]: Uh really. [1:08:45, 1:08:46]: With something that [1:08:46, 1:08:49]: I'm firmly convinced we are, and I understand. [1:08:49, 1:08:51]: You know, we we did this zoning. [1:08:51, 1:08:54]: And uh we approved it and we approved it. [1:08:55, 1:08:57]: In a manner that I'm satisfied with. [1:08:57, 1:09:01]: Today and I understand, you know, developers have to make tough choices. [1:09:01, 1:09:05]: Sometimes you gotta make tough choices. You gotta you might have to reduce [1:09:05, 1:09:08]: The overall number of units in order to fit it in there. [1:09:08, 1:09:10]: But at some point [1:09:10, 1:09:11]: It needs to fit in there. [1:09:11, 1:09:15]: Now I'm not the only one on this council and they'll have to make [1:09:15, 1:09:25]: the decision for themselves, but for me personally, I'm never going to vote to remove anything that we have and that we require because we're trying to raise the standards in the city. [1:09:27, 1:09:47]: Council member, um, I would like to reflect that um Brandon Road that was approved does not have tennis courts. And um, you know, it's easy to say remove a few units and put the tennis courts in, but all we're doing is increasing the amount of um HOA dues and assessments that this community is gonna have to. [1:09:47, 1:09:55]: To abide by because the bottom line is they are responsible for the maintenance and upkeep of these facilities. And with two [1:09:55, 1:09:56]: Um [1:09:56, 1:09:59]: uh playgrounds uh [1:10:00, 1:10:11]: A Olympic size uh tennis. I mean Olympic size pool. Um, we require to do a uh enclosed clubhouse. Um, we are really stacking up the amount. [1:10:11, 1:10:11]: Of [1:10:12, 1:10:31]: uh money that will have to be paid out by these residents in order to maintain this community. And the fewer units we have, the higher the dues are that they're going to have to pay. We believe that, you know, what we put forth is a quality community, that the amenities, quite honestly, [1:10:31, 1:10:37]: are over and above these amenities that we have in here are almost as extensive as the ones that we had on B Brandon Road. [1:10:38, 1:10:40]: Um and I think that [1:10:40, 1:10:40]: You know [1:10:41, 1:10:46]: If we're looking about quality, I think that, you know, we have established that with what we have. [1:10:46, 1:10:48]: What we had agreed to. [1:10:48, 1:10:52]: In essence, back on May tenth, it was after that time. [1:10:52, 1:11:12]: Uh, and certainly not our understanding because we would have gone back to put in those tennis courts if that was something that had been acknowledged to us at that time as being pertinent to getting this matter approved. So I would just respectfully request, I understand Councilmember Alexander's position. Um, obviously there [1:11:12, 1:11:32]: There are some other of you that are going to be voting as well. And I would just hope that there would be some consideration given to the fact that, you know, this particular community is stacked with amenities. It is not devoid of amenities. This is going to be a very, very nice community. And we want people to be able to come in here and be able to afford to stay. [1:11:32, 1:11:33]: Stay here. [1:11:33, 1:11:53]: And be incentivized to pay their HOA dues and not be so high that people decide, well, you know what, I'm just not gonna pay them. Um, and now we've got other problems because then we end up in other situations with foreclosures and liens and all kinds of other stuff. So again, we would respectfully request that that tennis court requirement be removed. [1:11:53, 1:11:57]: because we don't see a space on here to be able to place it. Thank you. [1:12:03, 1:12:04]: Mayor. [1:12:08, 1:12:12]: I'm sorry, I had Ms. Gang, go ahead. I'm sorry, I didn't realize I was muted. Go ahead, Ms. Gang. Thank you. [1:12:12, 1:12:13]: Who? [1:12:13, 1:12:14]: Who [1:12:15, 1:12:19]: told them that the tennis courts were a requirement in the first place. [1:12:20, 1:12:27]: Was this something, Ms. Johnson? Did you make this a requirement that they were required to have tennis courts? [1:12:34, 1:12:39]: So I'm I'm sorry about that. So um Council McGantt, the requirement is is in the code. [1:12:39, 1:12:46]: And it was added back for the applicant to review and respond back. [1:12:47, 1:13:01]: um on any changes or any say, hey, we can do it, we can't do it, what have you. And what Ms. Battle alluded to earlier as not having seen the email, the email was sent, confirmed, however, I don't think her team saw it. [1:13:02, 1:13:06]: Um but it was added back for that for that fact. [1:13:06, 1:13:11]: Is it our tennis recourt are tennis courts re a requirement in our code? [1:13:12, 1:13:15]: Yes, for RMRM three. Yes, ma'am, they are. [1:13:15, 1:13:16]: They are required. [1:13:16, 1:13:21]: Mm-hmm. Okay. Now I don't know what previous discussions were. [1:13:21, 1:13:26]: for the development agreement in 2003 when it originally got rezoned. [1:13:27, 1:13:31]: So I don't know what the conversations were around it, where it wasn't in the development agreement. [1:13:32, 1:13:38]: But when we went back through, I said, okay, we just have to make sure that we're not drawing any holes in what the requirements are. [1:13:39, 1:13:45]: as we you know update from 2003 requirements to where we are today in our code. [1:13:46, 1:13:46]: Okay. [1:13:47, 1:13:51]: So all subdivisions, all new subdivisions are required to have a tennis court. [1:13:52, 1:13:54]: For arm three, arm two and arm three. [1:13:55, 1:14:00]: Yes, if they are townhomes, condos, those types of things. [1:14:01, 1:14:03]: Oh, we typically try to do. [1:14:03, 1:14:10]: uh with with developments like these and new developments is um if you're phasing a project since this will be new. [1:14:10, 1:14:15]: You know, you don't have any residents to really talk to about, hey, what would you like to have in your community? [1:14:15, 1:14:19]: But as we have other developments that are phased in, phase two or three. [1:14:20, 1:14:25]: We have conversations between the builder and the HOA on what they'd like to see. [1:14:26, 1:14:31]: Um in this case we just kind of just did it bare bones as far as meeting the requirements of the code. [1:14:33, 1:14:34]: Okay. [1:14:34, 1:14:36]: And and a staff recommendation. [1:14:37, 1:14:41]: to keep the tennis court, what what is your recommendation? [1:14:41, 1:14:48]: Well, the recommendation is, you know, we don't staff doesn't necessarily an inherent issue with the tennis course not being there. [1:14:49, 1:14:55]: Um this is somewhat of a small development. They have a larger pool than what's required. [1:14:55, 1:14:56]: Um [1:14:56, 1:15:00]: And they have the trails, which of course are co co-required. [1:15:00, 1:15:02]: But um [1:15:02, 1:15:19]: I think it really just depends on how they believe the residents will actually utilize those amenities. Because really that's what it boils down to how and the type of use that the residents will have from those amenities. So we don't have a I don't have a major objection to it. [1:15:19, 1:15:20]: Um [1:15:20, 1:15:24]: But of course it is is the will of the council as far as what you like to see. [1:15:28, 1:15:28]: Yeah. [1:15:30, 1:15:32]: Any other uh Mr. Blount, go ahead, please. [1:15:35, 1:15:41]: Yes, thank you, Mayor. Um Ms. Brecker, what what is what are what are the uh code um [1:15:42, 1:15:46]: That you said there was not code, I'm sorry, the um um [1:15:46, 1:15:50]: zonings that we have that require [1:15:51, 1:15:51]: Um [1:15:52, 1:15:53]: Pools. [1:15:54, 1:16:14]: So under RM2 and RM3, those are your higher density types of developments like condos, like townhomes, where you would have that full list of um of amenities in that community. It doesn't have [1:16:14, 1:16:16]: have a trigger based on the number of units. [1:16:17, 1:16:23]: But it just requires that if you're building this type of community, that it requires you to have each of these amenities included. [1:16:24, 1:16:26]: Okay, follow-up question on that. Um [1:16:27, 1:16:30]: How many units are in this subdivision? [1:16:30, 1:16:33]: versus the units that we just approved for Brandon Rose. [1:16:34, 1:16:45]: There are 202 condominium units for this particular project. I believe it's uh 139 or so. And correct me if I'm wrong, uh Miss Battle. [1:16:46, 1:16:51]: That's correct. So uh lots single family detached for Brandon Road. [1:16:51, 1:16:54]: So what is a zone, Brandon Road zone? [1:16:55, 1:16:59]: Uh, I believe it's R3 as well. I have to double check that. [1:17:00, 1:17:04]: So we're looking at R three and so the requirements for that. [1:17:05, 1:17:14]: We didn't require them to put a tennis court there. It was that like a a a variance that was put in that we said, okay, you can build it without the tennis court. [1:17:15, 1:17:27]: Um I I I'm not for sure it was approved before I started with the city. But what I can do is go back and take a look at um what the requirements were at that time. [1:17:28, 1:17:30]: per conversations and the code itself. [1:17:32, 1:17:35]: Well well that's important because if we're approving [1:17:35, 1:17:36]: Um [1:17:36, 1:17:40]: subdivisions that are s have the same type zoning. [1:17:41, 1:17:46]: uh to have a variance in place for certain amenities. [1:17:46, 1:17:48]: Then we have to be careful and cautious. [1:17:49, 1:17:51]: When there's other menities put in another [1:17:51, 1:17:52]: Uh development. [1:17:52, 1:17:55]: that wasn't asked for but are that are um [1:17:56, 1:18:04]: I think are good amenities for that development, but then we put in a requirement to come in for that. So I would like the information. [1:18:05, 1:18:10]: to know when would the random uh what was if they're both [1:18:10, 1:18:11]: Can fall into R three. [1:18:12, 1:18:13]: Ден [1:18:13, 1:18:16]: How do we determine as a council? [1:18:16, 1:18:20]: Who gets to put in a tennis court and who doesn't? Either we're gonna stick with [1:18:21, 1:18:23]: This is the way it's supposed to be, or we're gonna [1:18:24, 1:18:28]: I I don't want to put in the hand the counsel to say, hey, who gets the tendency court and who doesn't? [1:18:28, 1:18:40]: Because I think that with this, in my opinion, with this development, they put in this uh really nice pool, they put in trails that are not under the coat. And I think those are excellent amenities for that area. And I'm looking at the uh [1:18:40, 1:18:42]: Outlay for the um [1:18:42, 1:18:44]: For the project itself. [1:18:44, 1:18:49]: And so s there was some seemed like there was some disconnect somewhere between [1:18:50, 1:18:52]: The city and [1:18:52, 1:18:59]: You, Ms. Battle, there was some disconnect somewhere when it came to paperwork and what you all understood versus what was required. [1:19:00, 1:19:02]: And so is that a fault of? [1:19:03, 1:19:08]: The developer or is that a uh oversight by the city? We don't know that as a council. [1:19:09, 1:19:13]: Because something something didn't connect somewhere what we're hearing today. [1:19:14, 1:19:18]: But then first of all, we gotta address that and find out who dropped the ball. [1:19:19, 1:19:22]: But this my second the the first point I made is [1:19:22, 1:19:29]: Is that we have to be careful when we have zoning for different developments, the same type zoning, but we can pick and choose. [1:19:29, 1:19:34]: the requirement codes for who who has to put in what type of development and who doesn't. [1:19:35, 1:19:38]: And so that's that's where I'm at with that. So [1:19:38, 1:19:46]: Uh Miss Bowder, I have no when when did you have an understanding, Miss Uh Battle, that you had to put in a tennis court? [1:19:47, 1:19:51]: We actually didn't know. [1:19:51, 1:19:53]: So um [1:19:54, 1:20:00]: It my understanding is I well not my understanding. I sent over an email with the changes to the development. [1:20:01, 1:20:03]: agreement along with a red line. [1:20:04, 1:20:11]: Um showing exactly the changes that we had proposed prior to the May 25th hearing. [1:20:12, 1:20:26]: Um, Ms. Johnson um sent an email out. Um, I cannot explain why I did not see it. I of course get a ton of emails, just like I'm sure she does. Um, so I'm not saying she didn't send it. I'm just saying I didn't see it. [1:20:27, 1:20:28]: Um and so [1:20:28, 1:20:29]: Um [1:20:30, 1:20:32]: And our engineer even said he didn't see it. [1:20:33, 1:20:37]: So I'm sorry, forgive me. What what was the email supposed to be stating? [1:20:37, 1:20:40]: The the email had a red line. [1:20:40, 1:20:41]: Of [1:20:41, 1:20:48]: the changes that staff had proposed to the um development agreement. [1:20:48, 1:20:52]: Um, which included not only the changes that we had made. [1:20:53, 1:20:54]: But also additional [1:20:54, 1:20:56]: changes that staff had made. [1:20:57, 1:20:59]: And at the hearing on the twenty fifth. [1:21:00, 1:21:15]: There was no we didn't see that markup and we didn't have any markup um before the meeting. I did not, I will take responsibility for that. I did not go online, pull off the agenda and look at what had been submitted to you all. [1:21:16, 1:21:19]: So on the twenty fifth, if you go back and read listen to the tape. [1:21:19, 1:21:22]: There was no mention about the tennis courts. [1:21:22, 1:21:27]: Um, and I would think that if the tennis courts were going to be required. [1:21:27, 1:21:32]: That we would have been told that we needed to go back and amend our site plan. [1:21:33, 1:21:35]: so that it would actually reflect. [1:21:35, 1:21:36]: The tennis courts. [1:21:37, 1:21:40]: Because this was conditioned on a site plan. [1:21:41, 1:21:43]: So this condition of adding the tennis courts. [1:21:44, 1:21:46]: Із актуальної ад. [1:21:46, 1:21:47]: To a certain extent. [1:21:47, 1:21:49]: with the um [1:21:50, 1:21:54]: approved site plan because our site plan clearly does not show any tennis courts. [1:21:55, 1:21:55]: So [1:21:55, 1:22:00]: Subsequent to the hearing, you know, we were all kind of going back and forth with [1:22:00, 1:22:02]: Um, the development agreement. [1:22:02, 1:22:03]: And I guess [1:22:04, 1:22:10]: None of us on our side was even thinking about tennis court. So nobody was, you know, thinking that that's what had happened and had been added in. [1:22:10, 1:22:13]: We signed the agreement as it was and we moved on. [1:22:13, 1:22:17]: as they were preparing for their LDP. [1:22:17, 1:22:19]: That's when we found out, oh crap. [1:22:19, 1:22:23]: We've got to put in tennis courts and where did that come from? [1:22:23, 1:22:27]: So then we had to go back and kind of backtrack to see when that language was put in. [1:22:28, 1:22:30]: So at this point, um [1:22:31, 1:22:32]: Again. [1:22:32, 1:22:37]: When we look at the Brandon Road and I I find it interesting because I did Brandon Road. [1:22:37, 1:22:42]: And during Brandon Road, there was no discussion about the tennis courts, and I'm not sure. [1:22:42, 1:22:45]: why that was Ms. Johnson was not here. [1:22:45, 1:22:50]: But I was not aware of any tennis courts then, and there are no tennis courts that are being provided. [1:22:50, 1:22:52]: Um, on Brandon Road. [1:22:52, 1:22:59]: Now, when I'm looking down um through the um district requirements and I'm trying to actually find [1:22:59, 1:23:11]: um in the R three and I must be missing something here, but I don't I don't see the requirement of the uh the tennis courts there. I do see in the RM district. [1:23:11, 1:23:17]: That it talks about tennis courts, but it also has that as an alternative. [1:23:17, 1:23:18]: Um that you've got to pick. [1:23:18, 1:23:23]: one of a couple of different things, a waiting pool, a tennis court, or walking trails. [1:23:23, 1:23:24]: Um we pick. [1:23:24, 1:23:35]: You know, I guess from our perspective, we pick walking trails. But I, you know, maybe that's the wrong section of the code that I'm looking at. And there, you know, Ms. Johnson can direct me to the to the right space because I'm not seeing it. [1:23:36, 1:23:37]: In the ar three itself. [1:23:38, 1:23:40]: But I'm not saying it's not there. I just don't see it there. [1:23:41, 1:23:41]: So [1:23:41, 1:23:42]: Um [1:23:42, 1:23:44]: I I guess. [1:23:44, 1:23:46]: You know, I hope that responds to your question. [1:23:47, 1:23:51]: Um, if we need to take more time to get this addressed, I that's fine too. [1:23:51, 1:23:53]: Um, I just feel that. [1:23:53, 1:23:54]: At the end of the day. [1:23:55, 1:23:57]: If that requirement and that it was. [1:23:58, 1:23:59]: was added. [1:23:59, 1:24:03]: That we should have been asked to update the site plan to reflect. [1:24:04, 1:24:11]: That we had to have a tennis court because then we would have been able to discuss that more fully at that time and would have known. [1:24:11, 1:24:16]: Okay, well, we're gonna lose some lots if we have to put these tennis courts in, but we may have also [1:24:17, 1:24:19]: had further negotiations on [1:24:19, 1:24:25]: You know, some of the amenities that we added because I don't think we were required to have two clubhouse, you know, two playgrounds. [1:24:26, 1:24:28]: We're not, you know, the the size of the clubhouse. [1:24:29, 1:24:30]: Um the pool. [1:24:30, 1:24:36]: Um, some of those other things. I mean, these are all costs and expenses that are gonna get passed along to these residents. [1:24:37, 1:24:41]: Um, and they are gonna be responsible for the maintenance and upkeep of them, not us. [1:24:41, 1:24:46]: So I just, you know, that that's where our prov our position is on it. [1:24:46, 1:24:54]: Yeah, my uh just a follow up, Mayor, and this is the point I'm trying to make and I I think I thank you, uh, Miss Battle. [1:24:54, 1:24:57]: Because when this site plan came to this council [1:24:58, 1:25:04]: I remember this council saying, Hey, we need this, we need that, we need this, we need that, and everything that we said we wanted. [1:25:05, 1:25:11]: That's what we have on here. And what was not on here at the time that what we said we wanted wasn't the tennis court. [1:25:12, 1:25:14]: Yet we approved this development. [1:25:15, 1:25:17]: Just like we did the Brandon Road development. [1:25:19, 1:25:24]: And if there's some discrepancies on on the language and understanding and the codes. [1:25:25, 1:25:31]: Those things should have been brought together or brought forward and those things should have been brought to counsel that hey [1:25:32, 1:25:36]: prior to approving this, this site plan should have been looked at. [1:25:37, 1:25:45]: And if there's any code or anything that doesn't meet the code in it, it should have been brought to us prior to us approving it. [1:25:45, 1:25:52]: But the site plan has been approved. All the amenities asked for by this council has been put on there. [1:25:52, 1:25:54]: And I'm gonna agree with Miss Johnson. [1:25:54, 1:25:57]: Is that uh I'm ready to approve it because [1:25:58, 1:26:03]: We just approved the development without a wit without a uh uh uh tennis court. [1:26:04, 1:26:05]: And right now [1:26:05, 1:26:16]: We are pr this this development has put in amenities in there that I don't think is commonplace in other communities. Uh with the the the junior size Olympic pool. [1:26:17, 1:26:24]: And and and the the the the pocket park and all these other things that were put in there. And if it was something in the code. [1:26:24, 1:26:39]: that wasn't in this development agreement uh uh in this site agreement, it should have been brought to us prior to tonight. It should have been brought to us prior to agreeing to this. This is not the first time these documents have come forward. [1:26:40, 1:26:47]: I'm not one council member that operates like this. So this is something that I say we have to be consistent in what we do. [1:26:47, 1:26:55]: Uh I think that you all uh Miss Ms. Bader with this development has put some awesome things in there that we've that we've asked for. [1:26:55, 1:26:58]: And if there's a discrepancy on something that we didn't ask for. [1:26:59, 1:27:04]: I think that we this council should move forward forward tonight in the in in approving this our project. [1:27:05, 1:27:05]: Thank you. [1:27:06, 1:27:07]: Okay, um [1:27:08, 1:27:18]: Mr. Alexander, uh you've already how many times have you spoken? Maybe we've spoken twice? Okay, go right here. Go right in. Let me make something perfectly clear. Okay. [1:27:18, 1:27:21]: The tennis courts should have been in Brandon Road. [1:27:22, 1:27:26]: Just like the chase bank on Eagles Landing should have had brick on it. [1:27:27, 1:27:29]: Prior to Miss Johnson's arrival [1:27:29, 1:27:31]: We weren't following the code. [1:27:32, 1:27:36]: Since Ms. Johnson has come, we're now following the code. [1:27:36, 1:27:39]: See, decisions were being made like [1:27:39, 1:27:41]: Giving a variance. [1:27:42, 1:27:43]: Which basically [1:27:43, 1:28:03]: uh was inappropriate to the chase bank so they did not have to have brick on the building even though we have a city ordinance that says mayor mayor we want to require mayor mayor 50 percent brick mayor forty percent standby please stand by uh what's what's what's what's the standby mr what's the point of order mr Blount what's going on here [1:28:03, 1:28:06]: Mayor, we have a project right in front of us right now. [1:28:06, 1:28:08]: And to deviate. [1:28:08, 1:28:26]: to another business and bel in in in this belitimate form of how they built the business. Hold the council. Inappropriate council. Poll the council. Folks, folks. Poll the council. Hold the council. No, no, no. Okay. Go ahead. Can I finish my point of order there? Yeah, please. Go ahead, please. [1:28:26, 1:28:32]: My comments were interrupted. Go ahead, Mr. Blount. It's not appropriate. [1:28:33, 1:28:39]: For this council to sit on here and make an example of inefficiencies of any business. [1:28:39, 1:28:42]: We're making a point on what we're trying to do here. [1:28:43, 1:28:47]: The point of order is that's a diversion of what we're dealing with. We're not [1:28:47, 1:28:51]: That's a done deal on anything that's been built and then and in progress right now. [1:28:52, 1:29:12]: We can't sit here and belittle anybody's development or what anybody's doing right now that has nothing to do with what's at hand right now, pertaining to our code, pertaining to this, what is the zone for? We need to stick to this and not bring any other business that's in the city of Stockbridge that's already built and done into this conversation. [1:29:12, 1:29:14]: Conversation I think is inappropriate. [1:29:15, 1:29:35]: Okay, thank you. Miss Alexander, please stay on task in reference to the speaker. But Mayor, wait a minute, wait a minute. I'm making a point that is exactly the point. Ms. Johnson's it was a Miss Johnson's credibility was attacked saying that she was making decisions that wasn't consistent with the code. When exactly she's doing just that. She's following the code. [1:29:35, 1:29:44]: She was reviewing the code and she saw that this development was deficient. So she made a suggestion to correct the deficiency. [1:29:44, 1:29:45]: And the code. [1:29:46, 1:29:56]: As we have seen before, as I said, the business that did not put the brick on the building, they agreed to put the brick on the building when we asked them to do it because it was in the code. [1:29:57, 1:30:01]: Even though that they were allowed, they were told to proceed without the brick. [1:30:02, 1:30:15]: In violation of the law, which it should have been brought to council because in order to override an ordinance, you have to pass you, you have to bring it to council like Miss Johnson is doing tonight. She's following the code. [1:30:15, 1:30:18]: Okay, if that ch if that if the Chase Bank had a [1:30:19, 1:30:19]: Okay. [1:30:20, 1:30:28]: Okay. Not wanting brick on the building and they would have brought it to us, we would have had to vote on it. We we we did not we did not follow the code. So in this case, the [1:30:34, 1:30:35]: Are you freezing up? [1:30:35, 1:30:36]: Looks like. [1:30:37, 1:30:41]: Ma Mayor Ford, can I ask a one question prior to this course? [1:30:41, 1:30:44]: Okay. She informed the applicant. [1:30:44, 1:30:45]: True email. [1:30:46, 1:30:56]: The applicant says they didn't get the email, they didn't respond, all of the above. But that does not change the fact that the code requires the tennis court. [1:30:57, 1:31:17]: Now again, we can go out on our own and we can diminish the fact that the code don't mean nothing. So if if tonight we're gonna go ahead and override the code, just why are we writing the ULDC again? If every time there's a code, somebody wants to uh take something out of the code, we okay with it. Brandon Rose. [1:31:16, 1:31:30]: Should have had tennis courts in it. Somebody approved it and brought it to the council without the tennis courts. That's what I'm saying. If Miss Johnson had a Brandon Road. [1:31:30, 1:31:35]: Run and roll and have tennis courts too. Okay, so [1:31:35, 1:31:46]: May Mayor Ford Mayor Mayor Ford Metaph ask one. Mr. Thomas, I'll come to you in just a second, sir. Ms. Battle, go ahead, please. [1:31:46, 1:31:53]: Um, could I ask um I and I should have asked this previously, and I apologize, uh, Ms. Johnson, for not asking that. [1:31:53, 1:31:55]: Could you please give me the code section? [1:31:55, 1:32:05]: that states that the tennis courts are required because I've been perusing through here and I honestly don't see it. I see it in the RM. Absolutely. Absolutely. Is section 12? [1:32:06, 1:32:07]: Point zero two [1:32:07, 1:32:13]: Point three zero one, I'm sorry, twelve, point zero two, point zero three one zero. [1:32:14, 1:32:21]: And it's multifamily residential district. It's RM1, RM2, and RM3 of the school scroll quite a bit. [1:32:22, 1:32:26]: Because there's a heading that says amenities and it breaks down each of the amenities required by code. [1:32:28, 1:32:29]: Okay. And [1:32:30, 1:32:37]: I don't know why I thought you said we resolved. One lighted and enclosed facility featuring a minimum of two playing courts. [1:32:41, 1:32:50]: And that's under uh amenities, is the letter F. It says when additional amenities are required, the developer of the property shall select. [1:32:50, 1:32:56]: From the following list of additional required amenities. So we can select from that list. Is that not correct? [1:32:57, 1:33:00]: And what we selected was the walking trails, not the tennis courts. [1:33:02, 1:33:02]: Okay. [1:33:03, 1:33:06]: And that would have been something that the council had to determine at that time. [1:33:06, 1:33:11]: Right, but it says that I can select right. It doesn't say that the tennis court is required. [1:33:12, 1:33:14]: Right. So I will think this what [1:33:15, 1:33:19]: What I've we've done on the staff level is just ensure. [1:33:19, 1:33:20]: That [1:33:20, 1:33:27]: The proper code requirements were provided to the applicant. We did not hear back from the applicant and move forward with. [1:33:28, 1:33:30]: The required um [1:33:30, 1:33:32]: Submittal to the council. [1:33:32, 1:33:40]: Um I don't of course as as Ms. Um Battle said, they missed it, they didn't see it, what have you, and there was no discussion. [1:33:40, 1:33:42]: Outside of them having seen. [1:33:42, 1:33:44]: So um [1:33:44, 1:33:46]: So this is where we where we are today. [1:33:47, 1:33:51]: Okay. Would it be possible to share the screen to show I've got that. [1:33:51, 1:33:52]: Um section up. [1:33:53, 1:33:55]: Um because it's clear that it it [1:33:55, 1:33:58]: While tennis courses it's an option, what is [1:33:58, 1:34:01]: specifically required for what I can see is the [1:34:01, 1:34:05]: A minimum of thirteen hundred square foot clubhouse. [1:34:05, 1:34:10]: A junior size Olympic pool and children's play area. Those are the things that are [1:34:10, 1:34:12]: А худо процент. [1:34:12, 1:34:13]: And then we are to select. [1:34:14, 1:34:19]: from the balance, which gave us an option of a waiting pool, a tennis court, a walking trail. [1:34:19, 1:34:27]: A central park or a pocket park, baseball fields. It gave us a laundry list of things we could choose from. And we chose the tennis court. [1:34:28, 1:34:31]: and the waiting I'm sorry, we chose the waiting pool and the walking trails. [1:34:32, 1:34:33]: And the pocket part. [1:34:35, 1:34:38]: Okay. And that's in the code. So this battle. [1:34:38, 1:34:45]: This is Jeremy. I respectfully I'm gonna disagree because the section says or such other amenities of equal or greater value. [1:34:46, 1:34:48]: А зикал має пров. [1:34:49, 1:34:50]: And that's what the council approved. [1:34:51, 1:34:56]: I mean I understand the council uh the council approved that and didn't even know that it was added itself. [1:34:58, 1:35:00]: Well, there was good foresight, I suppose. [1:35:00, 1:35:09]: I mean, you know, it it gave us options, and the options that we chose were the options that were shown on the site plan. [1:35:10, 1:35:21]: And so we approved it based on the site plan. And now we're being told that we have to add tennis courts, which was an optional choice based on the laundry list of things we could choose from. [1:35:21, 1:35:24]: Mm, I don't know if we need more time to to be able to reflect on this. [1:35:25, 1:35:27]: But but it just seems to me that [1:35:28, 1:35:35]: We had we presented what it was that we believed that we can install, which was over and above the regular stuff. [1:35:35, 1:35:41]: And so at this point, we're just trying to understand. We didn't understand how the tennis courts got in there. [1:35:41, 1:35:48]: Um, this would require a revision of the site plan, which means that we will be modifying the site plan that it was approved based on. [1:35:50, 1:35:56]: Gancement Thomas. Mayor. Stand by, stand by, please. Mr. Thomas, please. Go ahead, Mr. Thomas. [1:35:56, 1:35:57]: Thank you, Mayor. [1:35:58, 1:36:04]: Originally I was going to say I I appreciate this conversation, but look like it sort of went somewhere else. [1:36:05, 1:36:12]: But but but let me say this and a couple of things and I I appreciate this this dialogue because we have to get it right. [1:36:12, 1:36:15]: Uh, and I think we have to be consistent with that. [1:36:15, 1:36:20]: And even if when we're talking about mod modifying and upgrading. [1:36:20, 1:36:21]: The UDC. [1:36:22, 1:36:28]: Uh w we have to get it right. The language need to be clear. And and this is what I say. [1:36:29, 1:36:29]: When [1:36:30, 1:36:31]: A developer [1:36:32, 1:36:35]: Or developers come to the city of Stockbridge. [1:36:36, 1:36:39]: It needs to be clear and and I think Mrs. Johnson. [1:36:39, 1:36:44]: And I think you you're doing a great job in trying to clarify uh just that. [1:36:44, 1:36:45]: Um [1:36:45, 1:36:49]: And I Mrs. Battle, you you you you make a valid point there. [1:36:49, 1:36:50]: Uh um [1:36:50, 1:36:51]: Mr. Berry. [1:36:52, 1:36:55]: Uh you made a point and see, and the reason I'm saying all of this. [1:36:56, 1:36:57]: Is [1:36:57, 1:36:59]: There seemed to be [1:37:00, 1:37:02]: Uh it seemed to be not clear. [1:37:02, 1:37:08]: And then I think this is our role here today and going forward is to make it clear. [1:37:08, 1:37:12]: Now the the thing that I really want to say that [1:37:12, 1:37:16]: When we start uh allowing developers to come in [1:37:17, 1:37:21]: I'm thinking of those homeowners, those folks that are looking to [1:37:21, 1:37:24]: To move into the city of Stark Bridge. [1:37:24, 1:37:26]: Or they're trying to upgrade. [1:37:26, 1:37:30]: And so we want to make sure that the quality of life [1:37:30, 1:37:36]: uh for all of these folk that are coming in and and and they're looking to us to get it right. [1:37:37, 1:37:43]: So we have to get it right. So I'm not disappointed in this conversation tonight. This is it's the process of us. [1:37:44, 1:37:45]: Get it right. [1:37:45, 1:37:46]: Um [1:37:47, 1:37:51]: I saw a report recently about young [1:37:52, 1:37:53]: Black girls [1:37:53, 1:37:55]: That are [1:37:55, 1:37:57]: Uh infuse into tennis. [1:37:58, 1:38:07]: So I don't know if that's old school or not, Mrs. Battle. Now what what I see, I see a lot of young folks that's getting into tennis and getting into golf. I know we can't do a golf course. [1:38:08, 1:38:09]: But but I'm just saying [1:38:10, 1:38:12]: From my perspective [1:38:13, 1:38:14]: Health. [1:38:14, 1:38:16]: Wellness and fitness [1:38:16, 1:38:19]: I think those are attractive. [1:38:19, 1:38:21]: Amenities [1:38:21, 1:38:30]: that would be in any um new subdivision or any new uh development that is coming. And and and that's my perspective right there. [1:38:30, 1:38:33]: I I would only want to approve of [1:38:34, 1:38:38]: Something where it is going to be attractive. But again [1:38:38, 1:38:41]: We have to do these things, uh, w which is in the code. [1:38:42, 1:38:43]: So [1:38:43, 1:38:46]: I think what we are seeing here and what we're hearing. [1:38:46, 1:38:47]: Is that [1:38:47, 1:38:48]: Um [1:38:48, 1:38:50]: We're not communicating. [1:38:51, 1:38:53]: Code is not clear. [1:38:53, 1:38:56]: Uh, there's a breakdown somewhere. [1:38:56, 1:39:02]: So I think we have to sort of get it right because one thing I know that we want to do as a municipality and the city. [1:39:03, 1:39:06]: We do want to allow these developments. [1:39:06, 1:39:07]: We want to get it right. [1:39:08, 1:39:11]: And we want to be able to offer [1:39:12, 1:39:15]: these developments for folks that are looking [1:39:15, 1:39:17]: Uh to move. [1:39:17, 1:39:18]: To upgrade [1:39:19, 1:39:21]: So we have to just get it right. And so [1:39:22, 1:39:26]: And I and I guess Ms. Belly, you are on the uh development end. [1:39:26, 1:39:31]: Uh, Mrs. Johnson, you are on the staff end and I know you are about [1:39:31, 1:39:34]: The codes we are working on the UDC now. [1:39:34, 1:39:36]: Uh, we as a council. [1:39:36, 1:39:38]: We have to approve. [1:39:38, 1:39:54]: And so we're caught in a situation now. And see, we sh we shouldn't be. Uh it's good for us to have this, but at some point we this has to be straightened out. So when developers come and staff [1:39:54, 1:40:07]: We all communicate and we all know. So when we allow these um developments to come in, we should not be going through this. We should not be going through this. So at some point in time, [1:40:08, 1:40:10]: We have to get this right. [1:40:11, 1:40:14]: And and and if the code says one thing [1:40:14, 1:40:16]: We need to understand. [1:40:16, 1:40:21]: All parties need to know, the council need to know. We all need to know what the code really says. [1:40:22, 1:40:23]: So [1:40:23, 1:40:25]: And now here we are tonight. [1:40:26, 1:40:33]: Um not knowing whether we we should approve, do we need to approve, because we got conflict in and really. [1:40:33, 1:40:34]: Um [1:40:34, 1:40:36]: The interpretation of the code. [1:40:37, 1:40:41]: So Mrs. Johnson, I don't know if the language need to be [1:40:41, 1:40:44]: Uh change to make it very clear. [1:40:44, 1:40:48]: Um I I I'm I I really don't know the answer, but I basically [1:40:49, 1:40:56]: It needs to be clear so we can go ahead and move this city forward and to be able to offer. [1:40:56, 1:40:58]: Uh any new [1:40:58, 1:41:01]: Homeowners that are looking to come to stock grid. [1:41:01, 1:41:06]: And to be able to offer because I know if I was looking to purchase [1:41:06, 1:41:10]: I will be looking for all of these amenities, all of these. [1:41:10, 1:41:11]: Pooh. [1:41:11, 1:41:12]: Tennis court. [1:41:12, 1:41:13]: Travel [1:41:14, 1:41:16]: Um, you know, clubhouse. [1:41:16, 1:41:18]: That's what would attract me. [1:41:19, 1:41:21]: So I'm just saying we just need to get it right. [1:41:22, 1:41:26]: So we don't need the the back and forth and the argument. We just need to get it right. [1:41:27, 1:41:33]: So that's that's the challenge uh from the city park. We need to get it right. [1:41:34, 1:41:50]: Thank you, Mayor. No problem. Ms. Johnson, is there's a request. Can you actually the particular code we're referring to or part of the code, are you able to show that on a screen so we can all look at that? I believe that was something that Ms. Battle was asking about if you can show that so we can if it's possible to do that. [1:41:50, 1:41:54]: And on that, while you're doing that, if it's possible, why you're doing that, Ms. Gantt, go ahead, please. [1:41:56, 1:42:03]: Thank you, Mayor. I'm gonna let me just start off by saying um I do have some concerns about what I just heard. [1:42:03, 1:42:04]: And [1:42:05, 1:42:10]: I want to address them. I I I have some more additional questions I need to ask. [1:42:10, 1:42:11]: Um [1:42:11, 1:42:15]: Whether or not we've already signed a development agreement. [1:42:15, 1:42:22]: have the plans been approved for this particular project is my first question first two questions [1:42:22, 1:42:23]: Um [1:42:24, 1:42:25]: And then [1:42:26, 1:42:29]: I didn't really get clarity on [1:42:30, 1:42:38]: What how since the the language, if the language states in the code that they are to choose from the amenities. [1:42:38, 1:42:58]: Then how do we determine how many they have to choose from? What's what's the minimum amount of amenity amenities they have to have? What's the maximum amount of amenities do they have to have? And does that at the end of that code point of order wait a minute? And whether or not you're a point of order, right? Point of order. Stand by please. What's the point of order? [1:42:58, 1:43:05]: Mr. Uh, legal has legal has spoken on that particular issue. The legal act they spoke on that particular issue. [1:43:05, 1:43:20]: I'm asking she's giving the best the interpretation is being given no was counter by no legal. Let's let's bring legal back in. Mayor in order for me to make an educated decision on what's going on, I need [1:43:21, 1:43:27]: to hear direct answers, not roundabouts of oh well if council would have known. [1:43:27, 1:43:30]: Okay. I wanna know what exactly [1:43:31, 1:43:34]: Із за масиму и да мінімум ама. [1:43:35, 1:43:48]: of of amenities that a development of that size have to have per our code section and whether or not our code section says we as council upon the discretion of our approval of those amenities. [1:43:48, 1:43:53]: I need to know what our standards are for that before I make a vote. [1:43:53, 1:44:06]: Right. So back to Ms. Johnson. Are you still trying to find? Okay. Is that what okay, that's what I was looking forward to. All right. And you all see my screen still. Uh yes. Go ahead, share your screen, please. So we and walk us through this, please. [1:44:07, 1:44:27]: Okay, so um 12.02.039 is multifamily residential districts divided into three categories: apartments, RM1, fee simple townhomes, RM2, and condominiums are in three. Right. So we'll scroll down since this is RM3. I'm gonna scroll down to RM3. So a little bit less. [1:44:27, 1:44:28]: lengthy, so please bear with me. [1:44:32, 1:44:35]: That's RM1. That's the movies. [1:44:37, 1:44:40]: Isn't that the section? Cause it says in any of those three. [1:44:44, 1:44:47]: All right, this is arm two, and then we'll scroll down to arm three. [1:44:52, 1:44:53]: Okay. [1:44:59, 1:45:00]: Okay, here we go. [1:45:01, 1:45:07]: Um so this is arm three here, multifamily residential residence district condos. [1:45:08, 1:45:09]: Well two amenities. [1:45:12, 1:45:15]: Perpins Mata e Scar. [1:45:18, 1:45:19]: There you go. [1:45:19, 1:45:20]: Okay. [1:45:21, 1:45:22]: Here we are. [1:45:23, 1:45:31]: Uh required amenities except as otherwise provided herein. All developments under the section shall feature a clubhouse, including. [1:45:31, 1:45:43]: one uh minimum of 1,300 square feet, junior junior Olympic size pool and a children's play area. If subject to the requirements of subsection L increased density provisions. [1:45:43, 1:45:45]: Additional amenity shall be required. [1:45:46, 1:46:01]: Um the developer of the property shall satisfy this requirement prior to the completion of 50% of the development. What additional amenities are required? The developer of the property shall select from the following list of the additional required amenities. [1:46:01, 1:46:08]: or such other amenities as equal or greater value as the city council may approve. [1:46:08, 1:46:11]: They had to do the pool, they had to do the play area. [1:46:12, 1:46:14]: And the clubhouse. [1:46:15, 1:46:15]: Correct. [1:46:16, 1:46:22]: Wading pool, tennis course, walking trails. Um they did have additional density based on the verbiage. [1:46:23, 1:46:26]: Of the development agreement from my um interpretation. [1:46:27, 1:46:33]: And so this it just goes on as fair fairly similar throughout for arm one, arm two, and arm three. [1:46:34, 1:46:49]: So what we're saying is that's a list of things that this you're saying that the the developer can choose from to finish this aspect. Okay. Right. Which is which is why you know staff, we don't have an objection to as stated as to this request. [1:46:49, 1:47:00]: To me. And we picked waiting pools and the walking trail and the pocket parks. Those are the those are the things that you all asked us to include. And those are the things that we did include. [1:47:01, 1:47:03]: So the tennis courts was added. [1:47:04, 1:47:09]: No dis by Miss Johnson based on her interpretation. I'm not sure what led to [1:47:09, 1:47:17]: I'm sorry, I wasn't privy to the conversations that were had with city council about these amenities at all. I'm not sure. Um [1:47:18, 1:47:21]: But I did add it in and at that time at the council meeting. [1:47:21, 1:47:25]: then it will be discussed at that time. So all of this has been sent to the applicant. [1:47:26, 1:47:35]: prior to the council meeting. And it just was missed. We could have addressed this at that time. However, you know, here we are today trying to determine. [1:47:36, 1:47:39]: Um and if it's the will of the council, it's a determination of whether [1:47:39, 1:47:45]: this particular project for the size and where it is the topography. [1:47:45, 1:47:48]: Whether it needs to have these tennis courts or or it does not. [1:47:49, 1:48:09]: So is my sorry Mayor, Mayor? I'm sorry. I never got my questions answered. But you're what you're going to get answered just one second, please. I'm I'm going that way. Okay. So I in all actual in actuality, the the minimum amount is what's in the first paragraph prior to prior to getting to this that's not one point of order, Mayor. That's not what the legal said. Point of order. I we'll get the legal in a second, sir. [1:48:09, 1:48:29]: Can't stand by. So otherwise the minimum amount is what's in this first paragraph, it seems like. And then from A to whatever it goes, those seem to be additional things to select from, which give could give you the maximum amount, whatever that is. I don't think there's an actual number for max amount. It depends on what's available, what the land states and what you can put in there, I would imagine, and that aspect. That should be helpful. [1:48:29, 1:48:36]: I believe with Ms. Gantt, but I'm gonna go now, and now I said that, I'm gonna go back to Ms. Gantt. Now, Ms. Gantt, continue on, please. [1:48:37, 1:48:44]: Thank you, Mayor. I'm looking at the language in this code section and there's a it it's a it's May. [1:48:44, 1:48:58]: uh nothing is shall and there are options to choose from now they've already chosen their options um they submitted their plan for appro approval did they get approval [1:48:58, 1:49:16]: prior and then we they all of a sudden got an email from the city saying, hey, you also need to add in some tennis courts. I mean, my question is, what you know, I need to know what in what order did that take place. Number one. Number two, [1:49:16, 1:49:30]: The code doesn't say that they have to have tennis courts. When we first started this, I specifically asked Ms. Johnson, and no offense to you, Ms. Johnson, I understand, but I specifically asked, and we can run the tape, whether or not [1:49:32, 1:49:37]: tennis courts are a requirement and I was told they were. In fact they are not. [1:49:37, 1:49:38]: They are not. [1:49:40, 1:49:42]: And so, I want to make sure. [1:49:42, 1:49:58]: that we get I agree we need to get this right the first time. And if they've already have these amenities in place, then who are we to say, no, those amenities are not gonna work at this point in time if we had already agreed upon it. [1:49:58, 1:50:01]: So I need some type of legal interpretation. [1:50:02, 1:50:05]: Not oh well the count council decides to change their mind now. [1:50:07, 1:50:15]: All right. Uh Mr. Jeremy, you spoke earlier. How how can you add uh to this conversation and get this rectified here, sir? [1:50:16, 1:50:22]: Go ahead. Right. I mean I I guess I would just want to remind the council, as the council probably knows, the council is the ultimate decision maker. [1:50:23, 1:50:23]: And that [1:50:23, 1:50:26]: Аміднес є шос- [1:50:27, 1:50:29]: It says when additional amenities are required. [1:50:30, 1:50:35]: The developer of the property shall select from the following list of the additional required amenities. [1:50:36, 1:50:39]: О суч адремені з іquл отер валю. [1:50:39, 1:50:41]: as the council may approve. [1:50:42, 1:50:54]: So that last phrase, as the council city council may approve, gives the power to the city correctly. I don't think that the the develop respectfully, I don't think the developer is in charge. I think the city's in charge. [1:50:54, 1:50:58]: And I mean theoretically if the city wanted to do baseball fields [1:50:59, 1:51:01]: I agree with that. That's not what I'm saying. [1:51:02, 1:51:22]: I would like to respond because there's a section here below that says that we had to pick three additional amenities based on the number of units that we had, based on our density. And we picked three. We picked the waiting pool, we picked the walking trails, and we picked the parking parks because that's what was discussed. And so we picked those things. [1:51:22, 1:51:28]: The tennis courts would technically be four things. We were only required to add three. [1:51:28, 1:51:36]: But the tennis courts was added. So now that's four things. We weren't required to have four things. Ms. Battle, was it approved with those three things? [1:51:38, 1:51:46]: The approval that you all did was approved actually with the tennis courts because it was added in there, but it was never discussed. [1:51:46, 1:51:55]: Or even told to you all that I I've gone back and looked at the tape. I saw nothing that talked about the tennis courts being an addition, that that was pointed out to you all. [1:51:56, 1:51:56]: Okay. [1:51:57, 1:51:59]: This is my first time hearing about it being an issue. [1:52:00, 1:52:05]: Right. Ms. Johnson, did you send us an email in regards to the tennis courts? [1:52:10, 1:52:27]: I did not send an email to the council. I was not privy to the conversations with the council about this project prior to its coming to the council. However, I did send an email to uh Ms. Battle because what I wanted to do, she sent us a executable copy that she wanted to have submitted. [1:52:27, 1:52:35]: There were no highlights to changes whatsoever. So I went line by line in that document to make sure, like, okay, what what are we missing? [1:52:35, 1:52:38]: Is there any information that's not there? So I said, let me highlight in red. [1:52:39, 1:52:44]: all of the things that we're adding. I sent this document to the applicant. [1:52:44, 1:52:57]: and Mr. Steve Moore so they could review it and tell us, hey, we want to do this, we don't want to do this, can we change this? Can we change that? This was four, five, six days prior to the council meeting for the purpose of [1:52:57, 1:53:00]: us having this discussion on the staff level. [1:53:00, 1:53:04]: before it came to the city council. So the council could approve and we [1:53:05, 1:53:06]: They start building. [1:53:07, 1:53:09]: So uh does that answer your question? [1:53:11, 1:53:14]: Does I appreciate you responding and so [1:53:14, 1:53:17]: W when it comes to these amenities. [1:53:18, 1:53:21]: And having three that were already chosen. [1:53:23, 1:53:27]: that we were aware of because this tennis course is just coming up to me. [1:53:27, 1:53:29]: Today, tonight. [1:53:30, 1:53:31]: So I'm asking you. [1:53:32, 1:53:35]: I'm asking in in regards to that. [1:53:35, 1:53:39]: How do we determine how many amenities need to be? [1:53:40, 1:53:41]: At a particular development. [1:53:42, 1:53:43]: How do we determine that? [1:53:46, 1:53:55]: Well, the only thing in the code that says that there's an increased density provision. Now, the number, of course, the code keeps it wide open for the council to determine. [1:53:55, 1:54:00]: Whether needs to be equal or greater than what is required of the code. [1:54:02, 1:54:03]: Okay, thank you. [1:54:04, 1:54:17]: Okay. Okay. Um Quentin, Mr. Washington, you had your hand up here. Go right here, please. Uh Mr. Mayor, I would like to see if we can move this conversation along. And I guess the two ways we can do it is either we can have [1:54:18, 1:54:30]: Further discussions with Ms. Battle outside of the council meeting about this, or if the council wants to take a vote about it because ultimately it's council decision as to whether or not they want tennis courts or they don't want. [1:54:31, 1:54:36]: then they can make that they can make that decision. But ultimately I think it I think the [1:54:37, 1:54:45]: I think the developer and Miss Al is representing them very ably. Um, I would let I would let that be her call if she wants to. [1:54:45, 1:54:52]: talk with us some more about this because she's seen a bunch of questions from council or she wants to just have a vote and and let that be her call. [1:54:53, 1:54:57]: Thank you for that, sir. Before we move on though, or t even w look at taking a vote. [1:54:57, 1:55:00]: uh someone hasn't spoken yet. Miss Barber, what are your thoughts? [1:55:01, 1:55:01]: Okay. [1:55:02, 1:55:05]: Thank you, Mayor, for acknowledging me. [1:55:05, 1:55:06]: So [1:55:07, 1:55:11]: In reading this code, I understand that it only requires three. [1:55:11, 1:55:11]: Um [1:55:13, 1:55:17]: I'm thinking in terms of where this development will be constructed. [1:55:18, 1:55:21]: Um there's tennis courts right across the street. [1:55:21, 1:55:22]: At the park, isn't there? [1:55:23, 1:55:23]: Mm-hmm. [1:55:24, 1:55:28]: There is some down the street. Right. Down it's it's not right across, but it's down the street, yes. [1:55:28, 1:55:30]: Down the street. Okay. Um [1:55:34, 1:55:38]: Анасті, ам окей видися, акин надестан хали конфуз. [1:55:38, 1:55:40]: comes about, I'm okay with [1:55:41, 1:55:42]: Accepting [1:55:42, 1:55:42]: And [1:55:42, 1:55:46]: modification to the development agreement. That's all. [1:55:47, 1:55:57]: All right. So let's do this. On that note, is there is there a motion? Is there is there a motion to propose uh this this agree with this uh adjustment for the development agreement? [1:55:59, 1:56:02]: Is there a point? Oh wait so move for Blount. Is there a second? [1:56:04, 1:56:04]: Is there a second? [1:56:05, 1:56:07]: Mayor, I need clarification. [1:56:08, 1:56:10]: Well it well okay before is there a second? [1:56:12, 1:56:32]: Okay, what kind of clarification do you need, Mayor? Are we making a modification to say that we are okay with the three that they named originally and not the tennis court? Or are we saying modify to add a tennis court? Which one are we saying? Good good. Mr. Blount, you made a motion. Clarify your motion, please. No, no, I I was second in the motion when when Councilwoman Barber said that she was okay. [1:56:32, 1:56:39]: with it i i i i thought that was a part of a motion i just second well let me let me double check miss miss barber did you make the motion [1:56:39, 1:56:41]: Is that what you made? Or are you just making a comment? [1:56:43, 1:56:44]: No, sorry, I didn't. [1:56:45, 1:56:52]: You didn't make the motion. Okay. I need a motion, folks, to to to outline this development agreement what we're going to approve or disapprove. Is there a motion? [1:56:53, 1:56:53]: So move. [1:56:54, 1:56:59]: And okay, you need clarification on that on that, sir. Clarification on what on what do you mean by that? [1:56:59, 1:57:04]: Mm so moved on a motion, as Councilwoman Barr just said, to uh [1:57:04, 1:57:13]: A lot of modification. I'm I'm assuming that a modification is that they don't have to have tennis courts because in our code and what they've done show that they don't have to have tennis course. [1:57:14, 1:57:18]: All right, that's the motion that you're you're making a motion in that aspect. Is there a second to that motion? [1:57:19, 1:57:20]: A second. [1:57:21, 1:57:23]: Ms. Gantt Sexton's that we I guarantee we have plenty of conversation. [1:57:24, 1:57:25]: So all in favor of the motion, please indicate. [1:57:27, 1:57:33]: One, two. I'm not able to see the vote. Okay, you got Blount says yes, Barber says yes, Gantt says yes, the other two gentlemen. [1:57:35, 1:57:37]: Mr. Mr. Thomas. [1:57:37, 1:57:38]: Are you four again? [1:57:38, 1:57:54]: Well, I I I favor tennis court, so I I guess I'm on the other side of that. Okay, so I got uh Mr. Alexander, you say no. I suppose it was three, two. The motion passed. Okay. Thank you, Miss Battle. Appreciate your time and effort. We'll move on. Thank you very much. All right. [1:57:55, 1:58:01]: uh council consideration approve the updated youth council committee bylaws miss erica harvey please [1:58:07, 1:58:08]: Hmm. [1:58:10, 1:58:11]: Do you guys hear me? [1:58:11, 1:58:15]: Yeah, go ahead now. Okay. Good afternoon, Mayor and Council and City Staff. [1:58:16, 1:58:23]: Um, I can prefer you tonight for the approval for the updating of the Stockbridge Youth Council and the Stockbridge advisory uh bylaws. [1:58:23, 1:58:38]: The changes that were made were to clearly document policies, procedures, and to strengthen the programs to provide attendance policies and expectations for the members and the participants of the youth council and the advis uh advisory committee. [1:58:38, 1:58:52]: Um, I assume you guys had the opportunity to look over the bylaws. And so I'm just here to answer any questions that you guys may have as it pertains to um the changes that were made or the additions or changes that were made. [1:58:55, 1:59:02]: Any questions for Ms. Harvey about the the actual youth council bylaws for that and the leadership at all? [1:59:03, 1:59:05]: Mayor? Yes, ma'am, go ahead, please. [1:59:06, 1:59:18]: I don't have any questions, but I wanted to make a motion to approve the bylaws. Okay, that's right. All right. Second was Mr. Let you Mr. Blount second that? Yes, sir. Okay, good. Any further discussion? [1:59:18, 1:59:20]: If not all okay discussion. [1:59:20, 1:59:24]: No oh if not all no discussion. All in favor, please indicate. [1:59:24, 1:59:27]: Aye. Uh, three, four, Mr. Thomas. [1:59:28, 1:59:48]: Okay, good deals. Unanimous decision. Thank you, Ms. Harvey. Appreciate it. You're welcome. Um, okay, folks, I got my comment uh comment time here. Well, I want to clarify something in reference to the public comments uh earlier today. I would say Mr. Knighton that uh we'll make we'll gather up all the information, respond to those public comments, do that individual. [1:59:48, 2:00:08]: individuals and also make some type of adjustments because some of those comments were not accurate. We need to make some clarification, put it on the website with you and the PIO to make sure that they're clarified in some of those things and get that out there if you don't mind, sir. And as opposed to taking time to try to answer those right now in this aspect. So we'll make public will make a chance to to get that out there and clarify those things. [2:00:08, 2:00:28]: With that actual individual as well as for you on the general public. Um, this uh actually this is the 13th, so otherwise two days ago, as you well know, uh the 20th year anniversary of the 9-11 attack on our country. And so we'll never forget that. And obviously, we had an outstanding uh remembrance ceremony uh for the honor. [2:00:27, 2:00:47]: Honor the 20-year anniversary of that right is right here at Stockbridge at right in front of City Hall uh Saturday morning. Uh now obviously all of you uh would reflect back on what you were doing, how you felt at the time that this all occurred in this aspect. So I'm not gonna go through uh what I what I felt, but I know you all had certain ideas and sit and you felt [2:00:47, 2:00:54]: certain ways about this about a terrorist attack but i want to read a couple of things to you though in this aspect just in case [2:00:54, 2:00:59]: That terrorist attack on our country caused uh roughly two thousand nine hundred and seventy seven people killed. [2:01:00, 2:01:13]: And 19 of those folks were actually hijackers that committed murder and suicide. 6,000 plus people were injured. And it's continuing to count with the afterfact of these attacks on 20 years ago in reference to health issues. [2:01:13, 2:01:17]: 265 people were that were killed, that were on the four planes combined. [2:01:18, 2:01:38]: Roughly uh 2,606 people were killed at the at the World Trade Center and those two towers falling uh to the ground. 125 military and civilian personnel were killed at the Pentagon. And actually, it's even though this happened on our soil, there are more than 90 countries that were affected. So it's really a terrorist attack on these other countries as well. And I'm not gonna read the countries. [2:01:38, 2:01:58]: Countries, of course, of course, but otherwise, a multitude of countries and personnel from other countries died in this process. And then what you had that were heroes for the day were plenty of people, heroes for the day, not only in New York, but across the nation, and especially those heroes on the plane that crashed in in Pennsylvania in Pennsylvania field. But also that the New York finest, the police department. [2:01:58, 2:02:14]: Department, Fire Department, the Port Authority, and EMS, EET EMTs, I'm sorry, and paramedics, those heroes that died and also gave try to save lives in this process, uh perished in this particular horror horrific attack. So uh I think the city will continue to. [2:02:14, 2:02:28]: have our remembrance ceremony, I I would I would say, and it uh and it was is something that we we would as long as we live, we will never forget this this horrific crime and terrorist attack on our our country whatsoever. Um [2:02:28, 2:02:44]: Also want to let you know that COVID-19 and Delta Varin is still with us, folks. You know, earlier today you got a report from the Piedmont Henry Hospital that there are 151 uh COVID-19 patients in the hospital right now. [2:02:45, 2:03:00]: And as of this morning, 82 of those individuals are in ICU, this intensive care units, and and plenty of those folks are on ventilators. Now there is a little good news story in some of this, believe it or not, and that is that there's there's a before I mentioned to you about a shortage of oxygen. [2:03:00, 2:03:20]: Well right now Piedmont Henry seems to be maintaining that with the option needed for these folks to keep them alive in this aspect. So that's that's that's that's good news in that aspect. But once again, the the sad news, the bad news is the folks that are that are in the hospital in the ICU are people that are not vaccinated, typically about 95% of them. So what the what the logical combination [2:03:20, 2:03:31]: sense thing is to get vaccinated in this aspect. That'd be helpful in this uh in this case. Matter of fact, for the last two weeks in Henry County, there have been 2,118 new cases of COVID-19 in the last two weeks. [2:03:31, 2:03:51]: All right. That's not the worst number, but it is a bad enough number in this aspect. So vaccinations are key, folks. You can easily do that with the public health department. You can you can go get a uh COVID-19 Delta Varium vaccination at plenty, uh plenty of different drug stores and uh in the in the in the Henry County area and Stockbridge area itself. You can go to uh once again a public health department. [2:03:51, 2:04:11]: do that and make an appointment at 888-847-4262. All right. And uh you also get get tested for COVID-19 at the Red Hawk uh facility. You can get tested right there at uh Henry Parkway and uh you can do that as well. And uh they are actually available um anywhere from 9 a.m [2:04:11, 2:04:31]: To 3 p.m. uh every day of the week. And once again, that's Red Hawk Field at 143 Henry Parkway. It's very important that we're not going to eradicate this and stomp this thing out until folks get more get vaccinated and take care of themselves. And obviously, uh we need to take care of our children because obviously um only uh the Pfizer is a [2:04:31, 2:04:51]: Is available for 12 and older older uh kids. And then uh Mederma and the Johnson and Johnson, you have to be 18 or older. And now we're looking for other additional um verifications or or um FDA um uh qualifications to get things approved for other vaccinations, of course, in this aspect for the younger. [2:04:51, 2:05:11]: Age and that's coming soon in this aspect as well. But the point of it is, folks, you got to be careful. Wear the mask, watch your six feet distance, of course, wash your hands, use hand sanitizer, and get a vaccination. All right, another thing coming up, we talked about our precincts earlier this evening. And so that's November 2nd. We'll we'll get a chance to devote. [2:05:11, 2:05:12]: Right. [2:05:12, 2:05:32]: Municipal elections as well as T Sploss. T S PLOS, folks, we have to pass our T sploss on November 2nd. It's a five-year generated T S PLOS. And we passed that. That generates about$245,$250 million for an entire county. The city of Stockbridge would get roughly$30.5 million. [2:05:32, 2:05:51]: dollars if that passes on November 2nd we need you to do that and you have to do that at the county election um uh poll and uh booth or you can do it the early voting at Merrill Manor's conference center which starts on October 11th for early voting so part of the the city t splots deals with rock quarry widening [2:05:51, 2:06:11]: All right. From 138 to Hospital Road Drive there to uh hospital drive and Hudson Bridge Road all the way down down at one to 138. All right. And then of course we got several different uh projects within the pro uh within the city of Stockbridge itself, uh such as uh let me get to that list here, curb and gutter. [2:06:11, 2:06:31]: You're talking about additional uh uh street widening. Uh you're talking about Davis Parkway, Tie Street area for sidewalks, Davis Road, Curb and Gutter sidewalks, you know, extension of our Rees Creek Trail in a sense as well, Bush Creek, uh 1.5 miles needed there to expand that as well. Um, all kinds of [2:06:31, 2:06:51]: Expansion dealing with the our trail network along in the along Martin Luther King Senior Heritage Trail, Country Club Drive, traffic and safety improvements needed for also in Burke Street, Love Street sidewalks and pedestrian improvements, Wall Steven Road Trail, which is roughly 1.75 miles. All those things are needed, folks, for the city of Stockbridge. We will not be able [2:06:51, 2:07:10]: To have those increases and those improvements to the roads unless T-SPLOST is passed. If it doesn't pass, we will continue to have uh uh uh gridlock on the roads, we'll continue to not have sidewalks or trails, and it'd be very difficult to get improvements. So it's something that we must do in this note. All right, so please. [2:07:11, 2:07:31]: When you go to the polling booth on November 2nd, say yes to T Splas. Early vote October 11th, say yes to T Splas, please. On that note, let's talk about some additional announcements. Um uh city council uh retreat. Uh we have a budget retreat starting on Wednesday, Wednesday, Thursday, and Friday this week. And it'd be by way of Zoom. So public, you can listen in on [2:07:30, 2:07:50]: That if you want, and we'll be we'll talking about the getting ready for the 2022 budget year. Youth Council Advisory Meeting is 6:30 on the third Tuesday of each month. And the next time they have a meeting will be September 21st. The youth council meeting is 5:30 by way of Zoom, second Wednesday of each month, which would be October 12th. [2:08:22, 2:08:42]: And uh please join uh councilwoman uh barber uh for the uh at the Merrill Man's Conference Center for free Zuma fitness classes in the park uh every Saturday between uh every Saturday up until September through September 25th, 8 a.m. a Clark Park. You go there and get your Zoom on, get you some exercise. [2:08:42, 2:09:02]: And and and uh in this aspect. I'm pretty sure she'll enjoy everybody coming and joining her there. And uh also on the on the 20th of uh September, you got meet the mayor from 10 a.m. to uh 12 noon. I'll be able to talk with you about any questions and concerns you may have. And uh you have to set your appointment by calling 777-389-72. [2:09:02, 2:09:15]: 7900 and um and talk with Mrs. Zenobia and uh she'll set up an appointment uh for you to to meet me and have that conversation on September 20th. And of course, our Start Bridge Amphitheater Grand Opening featuring [2:09:15, 2:09:34]: uh gladest night and patty labelle saturday september 25th 7 p.m the uh well actually what it is is the concert is 8 p.m the the um if we probably get in a little earlier than seven we'll we'll we'll let you know what the actual time is because what we're planning to do right before that concert we're looking to have uh official ribbon cutting [2:09:34, 2:09:54]: So we have to let you in a little sooner than that. But the point of it is it's a great activity. It's going to be off the chain. We have a great time. You've got two wonderful uh icons in the music industry that are just going to entertain us all. I believe there's still some tickets on sale. Uh on Friday there were 60 left. And so I don't know what the what the count is today. Uh Mr. [2:09:54, 2:09:56]: tonight savings had they're all gone Mr Night. [2:09:56, 2:10:10]: They're all gone. As of about four o'clock this afternoon, I've been told that it's a sellout. It's sellout is is done. And by the way, it's only 3,200 folks, not 4,200 or 4,000 or 5,000. 3,200 folks. 3,200 folks. Okay. But we're going to be safe. [2:10:11, 2:10:23]: You gotta wear a mask, got to verify that you had a vaccination or and or show that you've had a COVID uh 19 uh test that is negative within 24 hours, excuse me, within 48 hours of the actual constant cell. [2:10:24, 2:10:24]: So [2:10:24, 2:10:28]: No need to mention uh the the the the site to go buy tickets if they're sold out. [2:10:28, 2:10:29]: It's a great thing. [2:10:30, 2:10:41]: All right. On that note, council, I'm done with my particular analysis right now, but we do need to go into Zechar session and uh Zechler session, please. I need a motion to go in a second session. [2:10:42, 2:10:45]: for litigation personnel and um [2:10:47, 2:10:48]: What else? [2:10:53, 2:10:56]: And real estate. Can I have a motion to go to the second session, please? [2:10:59, 2:11:01]: No motion to the second session? [2:11:02, 2:11:03]: Mm. Okay. [2:11:04, 2:11:06]: All right. So if there's no motion going to second session. [2:11:08, 2:11:16]: Then I guess uh no motion, no second. Well, in that name nature then unfortunately I'd say, well, okay, need a motion to end our council meeting then. [2:11:18, 2:11:20]: What does that mean? Your hands up means. [2:11:21, 2:11:33]: Okay, Mr. Blount, you've raised your hand to say that you want a motion. So moved to leave. To leave. Okay, Mr. Blount, to leave. Ms. Councilman Gantt seconds that motion. All right. All in favor, please indicate. [2:11:34, 2:11:38]: All right. Good night, everybody. Have a good life. See you soon. God bless you all.
