[0:25:40, 0:25:40]: [1542.0, 1543.0]: Yeah. [0:25:45, 0:25:50]: Ladies and gentlemen, I have a population here. Actually, a population actually fell over here. [0:25:51, 0:26:11]: deals with the actual one of years celebration, September celebration. As you probably will know that in August 6, 2020, it was actually the 100-year anniversary of City Stockers being incorporated as a city. But all of a sudden 2020, a lot of our activities were postponed. [0:26:11, 0:26:21]: Which regarded the DET until the pandemic, and obviously we're still in the process of learning that's not only type of stuff. [0:26:22, 0:26:42]: So they're a two-year delay, so we actually had a celebration yesterday to celebrate the 100-year celebration of the Centennial Cloud Same perfect. So I read the population last evening to the audience that was at the appetite last night, and I'll read it to you all day. [0:26:42, 0:27:02]: Where stockbridge was appropriated as a city on August 6th of 1920, near present-day old stage coach road in Hunt County, Georgia, and celebrating its 100th anniversary. Whereas Stockbridge is named for traveling professor rebuy stockbridge to pass to the area new time for post office. [0:27:02, 0:27:22]: Office from built. Whereas Stockbridge has evolved over the past century from a small, modern scrap city with a training people to a thriving first city of often 30,000 residents. Successful businesses and entrepreneurs and state and art facility. And whereas throughout the 1990s and early 2000s, [0:27:22, 0:27:42]: Stockbridge population surge by 750% of Jews in the community of talented workers in Metropolitan Walk. Whereas Stock Ray is an ancestral home of Dean Family and Birthplace in March King, home of Dean Rogan, Ed Rogan, and Bill Carpenter, of alternative rock band collective. Joey Clayton and Ricky Sanders, race car drivers, Mark Hall, the singer of contemporary Christian band, casting crowns, Chris Kennedy, the 2018 winner Bob Study Olympic. [0:28:02, 0:28:22]: Anderson, outstanding college football standout at the University of Alabama. Al James, former professional baseball player, and my currently Michael Harris, the current professional baseball player for the Labour Ravens. Whereas Tom Davis has been chosen as a location to hit films and television series, including 97, again, [0:28:22, 0:28:42]: Things, as a furious, McGiver, Stranger Things, and Black Panther. Whereas Starfree celebrates for 100 years, the city hood, as we continue to thrive, to be the most progressive business and family community in metropolitan Atlanta, with a strong focus on enhanced quality of life and use the most sustainable, live, working, play environment. [0:28:42, 0:29:02]: City Stockers believe people are the most valuable asset and deliver services to all city states. And witness thereof, I have 3007 case with city stock. Now therefore, I am much more about the virtual [0:29:02, 0:29:05]: But by virtual authority lesson we have an error. [0:29:14, 0:29:24]: celebration we have seen you start where is an I science along with Professor Holiday and the entire council. And of course we celebrated that delay last evening. Thank you. [0:29:49, 0:30:09]: All right, so item number four was deferred to the August 30th. So we have a public hearing. Item number five, comprehensive, comprehensive plan, amendment, case number CP-2022-01. The city of Stockbridge, Mayor City Council, will hear the comprehensive plan amendment request. [0:30:09, 0:30:29]: By Remy Rhodes Development LLC. The applicant represents by represented by Battle Law PC. The agent to change the future land use designation of certain property from low density vertical mixed use to high density residential to allow for mixed use development. The property contains two parcels as listed. [0:30:29, 0:30:35]: Below with sixty-eight point eight seven uh acres within the starbury city limits. [0:30:35, 0:30:55]: The Stockbridge City Count City excuse me, the Stockbridge Planning Commission recommends approval. Number 012-01003000. The smaller parcel contains 3.131 acres and comprises the property of 1036 Highway 138 across from Spivey River. [0:30:55, 0:30:59]: Road located on land lot fifty five of District 12. [0:31:00, 0:31:20]: Parcel number 012-01002000. The larger parcel contains 65.743 acres situated adjacent to the western side of the smaller parcel with a frontage on Highway 138 West across from a tributary parkway located on land lot 42 of [0:31:20, 0:31:28]: District twelve, presented by uh Breck says Brucka Carter here and Ryan uh Anderson. Mr. Anderson, sir please. [0:31:29, 0:31:41]: This slide was originally heard June 13th, City Council meeting, and at that meeting no vote was taken on the comprehensive plan of that to a failed motion. The cause of no action being taken, I've been support to tonight's city council meeting. [0:31:43, 0:32:03]: The proposed land use amendment is required to fill a state the rezoning of the subject property. Current currently, the low density vertical mixed use land use designation doesn't allow for the type of zoning the applicant is proposing based on density limits. Therefore, necessating the need for a land use amendment to high density residential, which allows [0:32:03, 0:32:23]: For the type of zoning that is being proposed. This agenda item is accompanied by a rezoning request whereby the applicant is seeking to rezone approximately 70 acres plus or minus located on Highway 138 west of I-75 and Mount Zion Bullet, Mount Zion Parkway from C1 and C2 districts to the PUD to allow for a mixed use development. [0:32:23, 0:32:33]: development originally containing forty eight thousand square feet of commercial retail space with two buildings, three hundred and sixty apartment units within eight buildings, and a hundred and [0:32:34, 0:32:36]: Two town homes within twenty-two buildings. [0:32:39, 0:32:59]: That was originally slated to be heard on June 13th, but was deferred to June July 11th. During that time, the applicant submitted a revised site plan that reflects a reduction in scale and scope of the proposed project. The applicant is now proposing 297 apartments down from 360 for a reduction of 63 units. [0:32:59, 0:33:19]: Also, the applicant increased the proposed number of townhomes to 128 units from 102 units. That will result in an increase of 26 townhomes, increasing the homeowner oppress homeownership opportunities for Stockbridge residents. The original site plan indicated a total of 462 combined units of [0:33:19, 0:33:39]: Apartments and townhomes, and the new revised site plan indicates 425 combined units. Overall, the site plan has a reduction of 37 units. The original plan had a proposed density rate of 6.6 units per acre, and the revised site plan has a density rate of barely six units per acre, which is on the low end of the spectrum for high density residential. [0:33:39, 0:33:59]: Which ranges from six to sixteen units per acre. Due to the subject property large size, location along a state highway, and proximity to interstates 75 and 675, staff deems the applicant proposal suitable, suitable for the area, and the proposal could serve as a catalyst for future commercial development in the area. [0:33:59, 0:34:12]: Staff recommends approval of the proposed land use amendment from low density vertical mixed use to high density residential. This item has an accompanying accompanying rezoning which will be heard later tonight. [0:34:13, 0:34:15]: I'd like to show some pictures. [0:34:15, 0:34:16]: All right, please sir. Thank you. [0:34:17, 0:34:17]: All right. [0:34:19, 0:34:29]: Uh here's an aerial photo of the well uh uh illustration of the vicinity zoning. This is the future land use map. [0:34:34, 0:34:40]: And this is the imagery rezoning of the entire project with the renderings and the site plan. [0:34:42, 0:34:45]: So I'll I'll leave that up and uh the applicant is here. [0:34:45, 0:34:50]: Okay. You applicant any additional comments, please come forward. [0:34:59, 0:35:10]: Good evening, Michelle Battle with Battle Law. Good evening. Good evening. 3562 Aversham. I'm at North Lake Tucker, Georgia. Um I'm gonna ask staff if we've got my PowerPoint. [0:35:20, 0:35:20]: Mm. [0:35:23, 0:35:29]: Oops wait minute that's not the right one. Click on oops. Let's try the other one. Click on that one. [0:35:31, 0:35:32]: Uh [0:35:34, 0:35:36]: Second one. Must have been that one. No, the second one. [0:35:37, 0:35:38]: Is that it? [0:35:39, 0:35:40]: Yes. Okay. [0:35:43, 0:35:51]: Great. Um tonight as we let me see if I can get rid of that at the top. [0:35:58, 0:36:12]: Oh, there we go. Okay. Um tonight obviously we are focused on the comp plan and I wanted to to actually go over a couple of things within your comprehensive uh land use plan. As I was reviewing it [0:36:13, 0:36:33]: A couple of things stood out to me as we talk about the change of this project from the low density vertical to high density. Staff has already put forth what their support is for this change in the land use. And when we look here at your comprehensive plan, we have talked [0:36:33, 0:36:53]: Talked uh about how uh there is a need to try to service um some of the population um that you all indicate that you want to attract to the city um or maintain in the city, which is um young folks. And so when we look here, um it talks about um non-family households represent [0:36:53, 0:37:13]: 31.2% of uh the total households in the in the city, that these non-family households will create some demand for smaller, higher density housing units, and that while single-family development remains attractive, in order to attract certain segments of the population, like young adults. [0:37:12, 0:37:32]: And millennials, other housing options should be available. That is in your comprehensive plan that was approved back in 2018. Currently there is a lack of townhomes and smaller multifamily residential housing. This type of housing, when included in mixed use developments, would allow for incremental changes in density, which would support the [0:37:32, 0:37:52]: The sort of lifestyle improvements that many Stockbridge residents expressed they wanted. Stockbridge could position itself to become a lifelong community by opening the door to new residents who may be more interested in living and working in Stockbridge without having to commute to a house immediately, commit to a house immediately, as well as empty nesters looking to downsize. This is in your [0:37:52, 0:38:12]: your own comp plan. We also look here that the housing related needs and opportunities were identified through existing conditions and community input that the city needs to encourage and maintain a mixture of housing options to accommodate both traditional and non-traditional households and attract young professionals. So when we talk [0:38:12, 0:38:16]: [2297.0, 2317.0]: We're only trying to achieve the goals that were stated in the comprehensive plan. We know that um there is not a heavy amount of apartment um units within the city. Um over forty percent of the um city's um acreage, that being uh three thousand four hundred and seventy-one acres plus is used for [0:38:36, 0:38:56]: Single-family detached housing. For apartments, it's only 266 acres at 3.1%. And this was in your statistics back in 2018. We look at our site here at 69 acres, and the closest apartment complex that [0:38:56, 0:39:16]: That is in the actual city limits of Stockbridge is over here at I think it's called Camden off of Paradite Parkway. That is the closest multifamily community within the immediate area. And you can see that here where residential apartments is in. [0:39:16, 0:39:36]: in this gold color and that would be um in this location but note there is nothing literally on this side of of the uh expressway um that provides or that has currently um residential apartments. Um you have to get further down and only in a few spots are they even located within the city boundaries. [0:39:37, 0:39:57]: We are asking for high density residential on this site, and as staff has already indicated, the designation is set forth in the land use plan and the comp plan says that uh multi-story condominiums planned developments, small commercial or other service businesses within these developments are [0:39:57, 0:40:17]: Appropriate when you've got high density residential, and that it is there to provide this transition again between the mixed use and industrial projects and low and medium density residential areas. So the city again has indicated that this is the type of zoning or land use, sorry, that is appropriate between the commercial corridor along Mount. [0:40:17, 0:40:23]: Mount Zion um and um and spivey not I guess it's like [0:40:27, 0:40:47]: Um again here we have the future land use. Um the high density um again the closest area would be over on the other side of the expressway. Um and even looking at medium density residential, it only takes you up to 3.6 units per acre. There's a huge gap in your um land use plan. [0:40:47, 0:41:07]: Plan from 3.6 up to the high density residential. So we are looking at the high density residential because that is the the designation that allows for us to do the density that we are proposing. But interestingly enough, we are not at the high end of that density. While we're asking for high density residential, we actually [0:41:07, 0:41:27]: high density residential goes from six units per acre up to sixteen units per acre. We're not asking for the maximum. We are literally at the six units per acre on the site. When we look at the staff's analysis again it states that although there are no other properties in the vicinity that have this high density residential [0:41:27, 0:41:47]: Land use designation that because of the large size of this lot, whereby the high density residential designation would not represent a small spot zoning designation. Its location along the state highway makes it suitable for high density development. Its proximity to a large C3 heavy commercial zoning district on its eastern side, which [0:41:47, 0:42:07]: Which is that red that you always see on this zoning map, and its proximity to low density use makes it appropriate as an interim density. And due to the location of the subject property along that state highway and its large size, it's unlikely that the type of land uses that are intended under that low density. [0:42:07, 0:42:27]: density vertical would actually be developed on this property. And so that is the basis for which staff has recommended approval. When we look at the site plan again, we have reduced our density overall to the six units per acre. We're at now 297 single family, multifamily units, sorry. The town [0:42:27, 0:42:47]: Home units, we increased 128. We changed the percentages that as well on the bedrooms so that we've now got 216 one-bedroom units, 108 two-bedroom units, and only 36 three-bedroom units. The town hall elevations include all brick fronts, as we've seen here. [0:42:47, 0:43:07]: Which was a change that was requested. And then we've also proposed these additional zoning conditions and we've provided this information to staff as well. One, that this project will be approved based on the conformity with the site plan as shown, with no more than 297 apartment units and [0:43:07, 0:43:27]: hundred and and a minimum of 128 fee simple townhomes, that there'll be a mandatory, I apologize for my typo, there show, be a mandatory homeowners association for the townhome community with a recorded declaration of restrictive covenants, which limits the total number of rental units in the townhome community to no more than 5%. [0:43:26, 0:43:46]: Which is a total of six units, that the frontage along Georgia Highway 138 adjacent to the apartment unit shall be landscaped with trees and shrubs as approved by the City Arborists in order to provide a visual buffer from Georgia Highway 138. The landscape strip shall be a minimum of 20 feet in width, that the apartment [0:43:46, 0:44:06]: Community shall be gated. There shall be a separate amenity area for the apartment community and the townhome community with a pool and a clubhouse for each community at a minimum. And that the townhomes shall be all brick fronts. We believe that this will hold our feet to the fire to do a development that is consistent with what we have presented to the board. [0:44:06, 0:44:13]: We'd ask for those conditions to be approved in conjunction with the rezoning. Um that hearing has already been held. [0:44:14, 0:44:34]: Um and again we just want to reiterate um the size of the units will be in the apartments from 720 to 1350 in square footage. Um no more than 10% are three-bedroom, 20%, I'm sorry, 30%, uh two-bedroom, and sixty percent at one bedroom. Um there will be parking um with [0:44:34, 0:44:54]: Some garages available to the residents at about 500 parking spaces with a pool, clubhouse, fitness center, co-working space, a multi-use trail. It will be gated. There will be security cameras, and we anticipate that the rental prices will be roughly 1,300 for one bedrooms, over 2,000 for two bedrooms, and 2200 for three bedrooms. [0:44:54, 0:45:14]: um with interior corridor entry um and again marketed to those young professionals and empty nesters that were reflected in the city's um comp plan. Um with the townhomes we're talking about um a hundred and no less than 128 units those sizes are between 1900 and 2100 square feet [0:45:14, 0:45:34]: um three bedroom units with two car garages, two par parking pad in front, pool clubhouse, the multi-use trail. There will be um the the price points we anticipate um now going up um more around three seventy five and up um on those units um and we've already agreed to the five percent [0:45:34, 0:45:54]: Rental cap and again we're marketing to empty nesters and young professionals. We have tried to do our best to address the issues that have been raised by City Council as well as the meeting we had recently with some of the community members from the [0:45:53, 0:46:13]: Clayton County area. We had a couple of meetings that we had sponsored with folks from that are actually residents of the city of Stockbridge in accordance with the requirements under the Stockbridge ordinance. And we believe that this is an amazing opportunity for the city to have quality housing that will allow. [0:46:13, 0:46:33]: For those young professionals and empty nesters to have a quality apartment complex to live in as an alternative to living in the predominantly single family detached homes that are a part of this community, which we know you all are very um supportive of and want to see continue in a very um and uh [0:46:33, 0:46:53]: um in a manner that really suits the the identity of this community, but at the same time wanting to allow some type of alternative home uh opportunities for individuals who may not be ready uh to actually buy a home. So with that, um, we are here to answer any questions and we thank you for your time and attention with this matter. [0:46:53, 0:46:58]: Thank you for your presentation, Miss Paddle. Uh council, questions, concerns? [0:47:01, 0:47:02]: Ms. Barber, go ahead, please. [0:47:03, 0:47:06]: Um, my questions are not for Miss Battle, it's for [0:47:07, 0:47:08]: Mr. Gartner. [0:47:08, 0:47:10]: Um Miss Carter is not here, is she? [0:47:12, 0:47:18]: Mr. Ryan Ryan Anderson is here. Come to the podium, sir. I think she has a question for you. Okay. Okay. Um [0:47:21, 0:47:22]: Okay. [0:47:24, 0:47:31]: So I have several questions actually. I know that staff along with our planning commission [0:47:31, 0:47:33]: has approved the plans. [0:47:33, 0:47:34]: Yes, ma'am. [0:47:35, 0:47:39]: Um one of the questions I have I know she just mentioned about the uh [0:47:39, 0:47:43]: Town homes are full sided brick. [0:47:44, 0:47:44]: Yeah. [0:47:45, 0:47:52]: Is it not in our standards for the apartments to be the same? Uh full sided four sided brick, no, but they have to have [0:47:52, 0:48:06]: The the frontage has to be made out of certain materials, but not the whole entire building. But it has it can't be made out of vinyl. Vinyl is prohibited. So it has to be made out of something like hardy plank or some kind of other fi uh cementous fiber material. [0:48:08, 0:48:13]: Can you show a picture of the apartments? The rent concept. [0:48:18, 0:48:21]: Departments. Okay. [0:48:27, 0:48:29]: Let me look for uh [0:48:32, 0:48:34]: Where? [0:48:34, 0:48:35]: Those are the town homes. [0:48:38, 0:48:39]: Do you know? [0:48:42, 0:48:44]: This one, let me uh [0:49:05, 0:49:15]: Thank you. Um so I did I have had uh a number of conversations with Miss Battle and Mr. Oro's. [0:49:15, 0:49:26]: Don't know if there I know Miss Battle is here. I don't know about Mr. Oro's. Um, in regards to the apartments, um, I wanted to see something [0:49:26, 0:49:29]: Distinctly different than what we si. [0:49:29, 0:49:32]: Nearby on the Clayton County side. [0:49:32, 0:49:34]: А болівді дезай оде. [0:49:35, 0:49:38]: Is uniquely different than what we see. [0:49:38, 0:49:53]: But the only thing that um I would have liked to see is more brick. Um I know that um they explained that with this design um brick may take away from it a bit. [0:49:54, 0:50:14]: Yes. Um in most situations in in I mean just nationwide you never uh really see apartments, four sided brick. Usually the front the frontage, the the area that's fronting, uh the front elevations usually have uh stone and brick, but on the side th there's usually hardyboard or some other fibrous cementus type material, but not [0:50:13, 0:50:17]: Um not brick all the way around, not four sided brick. Okay. [0:50:19, 0:50:21]: I can see that because it's in the same color. [0:50:22, 0:50:27]: Okay. And she says there's brick on the front on the first level on all the b on on all the buildings. [0:50:28, 0:50:37]: Thank you for that. The other question I have, and I don't know if this is a part of our build building standards, but because this particular item [0:50:38, 0:50:41]: that we're discussing um is requesting [0:50:41, 0:50:43]: uh council's approval to [0:50:44, 0:50:52]: Change the land use map from medium density to high density. From low density, vertical mixed use to high density. [0:50:53, 0:50:57]: Um, when I think about high density, I'm thinking about [0:50:57, 0:51:00]: a lot of um [0:51:00, 0:51:01]: Travelers. [0:51:02, 0:51:06]: uh or shoppers and residents, people who are coming in to dine. [0:51:06, 0:51:08]: For entertainment. [0:51:09, 0:51:12]: Or whatnot, but with this um [0:51:12, 0:51:13]: This [0:51:13, 0:51:16]: Concept or this plan doesn't allow [0:51:16, 0:51:25]: for those residents who may reside in this development to traverse throughout this block. [0:51:25, 0:51:29]: Um commercial development. [0:51:29, 0:51:38]: Uh I are you f I'm I don't mean to cut you off, I'm sorry. One of the concerns that I have is the ability for those who may reside here. [0:51:38, 0:51:42]: How would they get to the coals other than driving? [0:51:42, 0:51:43]: To coals. [0:51:44, 0:51:48]: Well um there are uh sidewalk requirements on the [0:51:48, 0:51:49]: On the front it's [0:51:49, 0:52:02]: um facing the st um the state highway part. So I'm not sure um until we get to the development plan phase whether or not we can um require them to put in sidewalks all the way around to the coast. [0:52:02, 0:52:06]: Can we require the stub out? [0:52:06, 0:52:14]: Um so that any new development that may come to this particular area that they're able to connect it. [0:52:14, 0:52:23]: Yes, ma'am, you can you can you can require that as a condition. You can you can make um additional conditions for approval as you see fit. [0:52:27, 0:52:28]: Okay. Thank you. Okay. [0:52:30, 0:52:50]: Any questions? Ms. Alexander? Sir, what we have really done is we had the public hearing already. We've listened to um you know basically we're rehashing. No, this this part is a public hearing. The public will get a chance to respond to this one. No, no, we we we had I think maybe on the attorney we've already had the public hearing. [0:52:50, 0:53:10]: We had for item number six. Is we ever had a public hearing? We're doing the rezoning for the comp plan, which is what we're working on now. We had that uh public hearing already, is that correct? We we had um uh a public hearing on this item on June thirteenth, but no uh action was taken. So right, but we heard from uh [0:53:10, 0:53:23]: us and we heard from the public. So for us to go back to uh basically resaying what we've already said, uh we've already had the public hearing. Can we appeal to the attorney to make sure to understand that correction that we did have the public hearing? [0:53:25, 0:53:30]: who is the author of our UGC code on this just to answer this question for you to count. [0:53:31, 0:53:32]: Could you come to the mic, please? [0:53:44, 0:53:45]: Good evening. [0:53:46, 0:53:46]: Which is [0:53:48, 0:54:08]: So it's my understanding that because the June thirteenth uh city council meeting did not result in any motion on that this specific agenda item, it was readvertised for another public hearing. And so that is why tonight you're going forward with another public hearing because it was re-advertised for this this meeting. [0:54:08, 0:54:08]: Yeah. [0:54:09, 0:54:10]: Okay. [0:54:11, 0:54:15]: Thank you. You're welcome. All right. Any further questions, Council? [0:54:17, 0:54:36]: No further any further questions? No? All right. So on that note I will open up the public hearing. All right. So uh I will start with four four for this comprehensive plan amendment, this change. We'll start from my left, which is a right over here. Anybody wants to speak on for this particular change on the far left side. [0:54:38, 0:54:41]: We'll go to the center. Anybody in the s in the middle? Four. [0:54:42, 0:54:47]: Four the uh for agreement for it. If you want it you do no? Okay, four. [0:54:47, 0:54:52]: My far right side, anybody four, just comprehensive taint. [0:54:53, 0:55:03]: Okay? Now if if we guess if you're not for this particular change and you wanna make a comment against this particular change for mine on my left side, we're up this far left, my far left side. Any comments over here? [0:55:04, 0:55:04]: Yeah. [0:55:06, 0:55:10]: For the comp for the complaint. That's what I mentioned. We're talking about the compliant. [0:55:10, 0:55:13]: The change recommended change for the comp planned that we're talking about here. [0:55:13, 0:55:16]: Right? Far left side. Anybody in the middle? [0:55:17, 0:55:18]: Any comments in the middle? [0:55:22, 0:55:32]: We're doing two ten and ten, correct. W screw me now? We're doing ten and ten, correct. Well we we can we'll s we'll s we can do that. But okay, anybody in anybody in the middle [0:55:33, 0:55:35]: And comments against this change for this comp plan. [0:55:36, 0:55:43]: All right, then I need for you to line up on arm on his far side, please. This line up on his far side. Over on this side, over here. Mark left side. [0:55:44, 0:55:45]: [3346.5, 3348.1]: Oh you need it they need to sign up over there? [0:55:51, 0:55:52]: Mm-hmm. [0:56:00, 0:56:16]: Anybody else from my my far right that have making comments for f for the comp plans different from the comp plan there, all right? Needs I need to go ahead and fill out the document over here. Um if you're gonna if you for the far right if you wanna speak against this particular adjustment on the comp plan. [0:56:33, 0:56:36]: Okay, we got some w what we got okay, good deal. [0:56:36, 0:56:43]: I'll take the first continue. We'll we'll max out a ten people if we if we have ten. So if you're already signed up, I need for you to come to the podium. [0:56:44, 0:56:45]: Your name and address, please. [0:56:48, 0:56:59]: My name is Mary Wilkerson. I live in the Glen Devon subdivision, seventy-seven eleven Devon Circle. I'm the only house down in the Little Valley. [0:57:00, 0:57:01]: by the um [0:57:02, 0:57:22]: Development. I'd like to ask a question of uh battle law first. I'd like to know what the amount of um acreage is going to be between the subdivision and the development because my house abuts right up to it. And I had been promised before a minimum of a hundred uh feet and I wondered what [0:57:22, 0:57:27]: What this they were going to propose because I'm right there on the property line. [0:57:28, 0:57:32]: That's my first question. And then I wanted to also state that um [0:57:33, 0:57:53]: The traffic situation, if there's only one in and one out, will be for this number of people and this amount of uh usage would be very challenging. There needs to be an entrance from the Mount Zion Road that they could access, especially the townhomes. Who wants to go by all these apartments to get to your town? [0:57:53, 0:57:58]: townhome and I'm one of those empty nesters that you're trying to appeal to. I would never [0:57:59, 0:57:59]: Never. [0:58:00, 0:58:20]: entertain a house in that side that division because I would not want one way in and one way out. There needs to be multiple ins and outs and I especially sidewalk traffic because I I would want one if I want to walk to Coles or if I want to walk to uh you know that CBS, I don't want to go on the main highway at [0:58:20, 0:58:22]: at my age. [0:58:22, 0:58:37]: a convenient path. So I'm opposed to this development, not just because my house abuts it, but because it's traffic. I'm concerned with the crime issues. And I'm also concerned with the amount of money that has to be paid for rent. [0:58:37, 0:58:41]: This is a lot of money for even young professionals to pay. [0:58:41, 0:58:58]: And and homeowner in today's market. I know you can't buy anything for less than four hundred thousand dollars. And this is a lot of money for a town home too. So that's just my feelings on it. And thank you for listening. Thank you. Uh bat Miss Battle, or or can you answer those questions for you, ma'am? [0:58:59, 0:59:19]: I'm sorry, you know, you know, good point. Thank you very much. Ma'am, you're you're done. And uh by the way, uh Vanessa, uh um ladies and gentlemen, three minute time limit, please. Okay, thank you. Next person up, thank you very much. Give me straight. All right, next one. Name and address, please. Good evening. My name is Christopher Calandro. I reside in Spivy Glen, where I am a charter resident and [0:59:19, 0:59:20]: [3561.7, 3570.0]: This evening marks my third appearance before this body regarding what I consider to be a misguided mixed-use development plan put forth by Battle Law and their client crescent. [0:59:30, 0:59:41]: In the first two installments I've made cogent, trenchant arguments regarding something I know more than a little about, that being traffic infrastructure and traffic impacts and its subsequent effect on quality of life. [0:59:41, 0:59:46]: However, I'm getting the distinct impression that members of this council are not taking us seriously. [0:59:47, 1:00:07]: Therefore, I've come here tonight, compelled to use uh stronger, maybe even impolitic language to effectively communicate the zeitgeist of the feelings of this community, people behind me regarding this mixed use development, because as my last boss excuse me, Mark Cuban once told me, sometimes loud and nasty is the only way it sticks. So maybe the third time will be the charm when I tell you. [1:00:07, 1:00:27]: You this approval of this plan of this development is simply a recipe for misery bordering on malevolence because it's being put forth by miserable people. People have been exactly forthcoming about plans to put apartments on the lots between Ingalls and Brettwood Park on Walt on Walt Stevens, a high density plan, and another setup by Spivey Cobbins. [1:00:27, 1:00:32]: 400 units according to my research, which I submit to everyone in this room, is a lie by omission. [1:00:32, 1:00:38]: And now our elected betters, along with the battle law firm and crescent, want to add a third turd to this crown of excrement. [1:00:38, 1:00:41]: Allow me to disabuse you of this notion. [1:00:41, 1:00:50]: Uh Councilman Blount, you weren't here the last for the last installment. Uh but if you weren't here, I'm gonna just fill in a knowledge gap for you. Councilman Alexander lamenting the dearth of [1:00:50, 1:01:10]: Of activities for the millennial and the Gen Z Scent, citing their desire to quote unquote be where the action is. Well, if that is the case, Mr. Alexander, I would remind you that Atlanta, Georgia is the ninth largest MSA in the country. That's metropolitan statistical area. So if someone was to reside where the action is, I would submit to them, they can hop in their car. [1:01:10, 1:01:30]: And you know you're absolutely right. Thank you for that. Appreciate it. And using drag to remarks to point out any single member council members is is unauthorized. So keep your comments uh [1:01:30, 1:01:49]: Directed to me as a chair and an aspect and Okay, fair enough. Back to my earlier point. They can hop in their car if they want to be their action is they can hop in their car. They can sit at the 75-138 interchange and wait for three light cycles, which I did today before any of this development is taking place, and they can head inside the perimeter to reside in any of the hippocol neighborhoods ITP. [1:01:51, 1:01:58]: I feel compelled to illuminate all of you, all of the members of the council and the chair, on the delineation between urban and suburban. [1:01:58, 1:02:18]: If I wanted to live in this self-styled utopia that you proposed to this multi-use plan, uh if I wanted to live in the box and eat the bugs and deal with the crime, I would live in the city proper or in the in any major American city, okay? But I don't want that. I prefer to live in the house, eat the steak, and enjoy the yard, which is why I relocated to a suburban locale. [1:02:19, 1:02:20]: Mm-hmm. [1:02:23, 1:02:29]: Can't can't say that now, but according to the last rule. So anyway, uh again, this is a recipe for misery. [1:02:30, 1:02:47]: Uh if you include this development, the development on uh sp on Walt Stevens between Ingalls and Brentwood and the other development that no one's talking about,'cause no one is taking holistic view of this particular development, again, right now traffic is bad. It will be inordinately horrible if we go through with this plan. [1:02:48, 1:03:08]: Uh the city's mission promise, which if you haven't read lately, I like to refresh your memory. The City of Stockbridge, your mission promise is to provide visionary leadership and superior municipal services that enhance the quality of life for citizens while creating a welcoming business atmosphere focused on sustainability and expansion of tourism. [1:03:08, 1:03:10]: and cultural events. [1:03:10, 1:03:12]: If you think that's what you're doing here. [1:03:12, 1:03:15]: I would submit to you you're they're incredibly m misguided. [1:03:16, 1:03:25]: And that if you ran this through, I've just got an an attitude from this members of this council of haughtiness, superiority, uh bordering on uh [1:03:26, 1:03:39]: Actually I conducted a focus group of some of the residents. Uh some of you were characterized as arroGantt, haughty, snotty, snide, condescending, and sanctimonious using terms like change is coming and that we need to make the necessary adjustments to accommodate it. [1:03:40, 1:03:49]: I would have thought this council would have learned the lessons of the spear road closure for six months, which was an unmitigated disaster. This will only compound that particular scenario. [1:03:50, 1:04:06]: So all I can tell you is if you insist upon yourself, this body, by pushing this through, in addition to the other two by the way uh Councillor Battle, I just find it incredibly gross that you can stand up here and have the audacity to lie to this chamber and the citizens. Dr direct the comments to me. I'm the chairman. Fair enough. [1:04:07, 1:04:15]: So anyway, uh hell hath no fury like a community scorn. I represent a group of individuals that are prepared to uh [1:04:15, 1:04:16]: Well, basically to uh [1:04:17, 1:04:34]: In inflict pain both politically and legally. Politically it would take the uh the form of ad buys, uh thirties, sixties, billboard ads, uh internet interstitials, and legally probably filing for injunction to stop this project. If if the si if the uh council uh deems uh [1:04:35, 1:04:37]: Deems it necessary to go forward. [1:04:37, 1:04:39]: Good luck with your decision, thanks for your time. Thank you. [1:04:40, 1:04:47]: And maybe we must be appeared to the three minute time frame. Uh Miss Solidary, please. Next person, individual. Come on, ma'am. Name and address. [1:04:51, 1:04:58]: My name is Susan Snare and I live at seven seven fifty Glen Devon Road. [1:04:58, 1:04:59]: And [1:04:59, 1:05:01]: This will be right behind my house. [1:05:02, 1:05:03]: With [1:05:04, 1:05:05]: Fifty yards. [1:05:05, 1:05:06]: In between [1:05:09, 1:05:11]: And all the traffic coming out. [1:05:11, 1:05:15]: If it's going towards Lakes Five you now? [1:05:15, 1:05:19]: is gonna be coming and blocking the entrance. [1:05:19, 1:05:21]: That we come out of [1:05:21, 1:05:24]: And we already have a hard time getting out already. [1:05:27, 1:05:31]: These houses and the prices they they're pricing amount. [1:05:32, 1:05:33]: During this time [1:05:34, 1:05:37]: Unless you won the lottery, you're not gonna buy'em. [1:05:38, 1:05:41]: They're gonna have to sell'em though, and they will [1:05:41, 1:05:47]: put the prices down until they can find somebody to get in them. [1:05:48, 1:05:49]: And we don't want that. [1:05:54, 1:06:03]: Like the ladies behind me over here said, they need another option to get out instead of getting out on highway one hundred thirty eight. [1:06:04, 1:06:09]: They can have a road all the way over to Mount Zion and get out that way too. [1:06:09, 1:06:12]: And that way it will divide some of the traffic. [1:06:17, 1:06:18]: I'm against it. [1:06:19, 1:06:23]: And everybody in here is against it. You don't have anybody. [1:06:23, 1:06:24]: Speaking for it. [1:06:25, 1:06:26]: And yet y'all can [1:06:27, 1:06:28]: Continue. [1:06:29, 1:06:30]: To want to push it. [1:06:32, 1:06:33]: That's all I have to say. [1:06:33, 1:06:34]: Thank you. [1:06:37, 1:06:38]: Oh thank you. [1:06:40, 1:06:45]: Well this individu we're gonna give each we'll give this individual each individual three minutes is what I'm referring to. [1:06:46, 1:06:53]: Go ahead, sir. Name and address, please. Good evening. My name's Charles Devonshire. I live at twenty nine sixty-four Lake Park Drive, Jonesboro. [1:06:55, 1:07:00]: I just became aware of this a little while ago and the aspect [1:07:01, 1:07:08]: Just go re no you restart it. Restart it restart the clock, please. Give'em three minutes. That's fine. Go ahead, sir. [1:07:08, 1:07:11]: But the aspect of going from a low density [1:07:11, 1:07:13]: To a high density. [1:07:13, 1:07:17]: In this area, in my opinion, is not the right thing to do. [1:07:17, 1:07:18]: Um [1:07:19, 1:07:31]: I was hearing the numbers earlier today. This one apartment complex that you're looking at doing would increase your apartment rentals, I think it was by about thirty-three percent from what you previous presently have. [1:07:32, 1:07:33]: By Acreage. [1:07:34, 1:07:54]: in one area as opposed to all over the existing city of Stockbridge. So you're gonna have a one-third increase in just one address or location, which is a huge amount for an apartment improvement. Just down the road in Clayton County, they're proposing a hundred and eighty [1:07:54, 1:08:02]: Hundred and sixty five units right now of townhouses, which is also going to be dumped onto the one thirty eight, not yeah, the one thirty eight high corridor. [1:08:03, 1:08:23]: 138 corridor is going to get overrun as it is right now. You add this with the traffic flow pattern. You don't have really the infrastructure to carry it, even though it is a highway. It's just a you know disaster to be coming. I would hope you would vote against it. That's my [1:08:23, 1:08:30]: Thank you. Thank you. Restart the clock, please, Ms. Uh Holliday. Next gentleman. Name and address, please, sir. [1:08:34, 1:08:46]: Thank you all for adding extra time. Uh I agree with everything that Charles said. It's quality of life. Oh, could you name and address, please, sir? I'm sorry. [1:08:46, 1:08:50]: Tim Kobe has been hearing in Jonesburg for [1:08:51, 1:08:54]: Forty five or more forty five years. [1:08:55, 1:08:57]: My friends ask me if [1:08:58, 1:08:59]: When I moved [1:09:00, 1:09:10]: to the south side, to open my practice. What's wrong with you, man? Why why aren't you going north side? I said, [1:09:10, 1:09:11]: Cause [1:09:12, 1:09:13]: Southsides and people side. [1:09:14, 1:09:34]: And it's a community side. And I've been here, raised my kids here. Um I won't do the statistical rehash that Charlie did. When I'm on all the conversation, pretty pictures, he alluded. [1:09:34, 1:09:46]: to the project that they have tabled in Clayton County off Grand Road one thirty eight, tabled for more consideration. [1:09:47, 1:09:49]: The apartments they're building over there. [1:09:50, 1:09:52]: Uh count behind loose. [1:09:53, 1:10:03]: This is a community, this is an apartment situation, and not a single person, single person has said [1:10:04, 1:10:05]: Schools. [1:10:06, 1:10:09]: Safety for the kids, medical. [1:10:09, 1:10:11]: Infrastructure. [1:10:11, 1:10:12]: You dumb back. [1:10:13, 1:10:18]: Putting a lot of folks who have this [1:10:19, 1:10:21]: Sales pitch for [1:10:22, 1:10:29]: Your home, quality of life, where these kids gonna play. Busy street here, busy street there. [1:10:30, 1:10:31]: What are they gonna do? [1:10:31, 1:10:33]: Where are they gonna go to school? [1:10:33, 1:10:37]: How they gonna be cared for and as I said infrastructure. [1:10:37, 1:10:40]: Lest I say police which is [1:10:41, 1:10:41]: Here's a [1:10:42, 1:10:45]: Word you're not supposed to say anymore, but safety. [1:10:46, 1:10:47]: An integration. [1:10:48, 1:10:49]: Please. [1:10:51, 1:10:51]: Yeah. [1:10:52, 1:10:55]: My my practice was in Clayton County. [1:10:56, 1:10:56]: I was [1:10:57, 1:10:58]: Part of the stuff. [1:10:59, 1:11:04]: Don't be stupid. They've been stupid in a lot of areas, but [1:11:04, 1:11:20]: Don't follow the the leader and don't be overrun by all of the brick on the front, oh not on the back. That's so insignificant in the big picture. [1:11:21, 1:11:22]: And I'm here. [1:11:23, 1:11:26]: resident obviously of Jonesboro [1:11:27, 1:11:30]: But I'm here because I care enough for [1:11:30, 1:11:33]: I've friends in Stockbridge, Henry County. [1:11:33, 1:11:36]: I've been here for forty five years. [1:11:39, 1:11:40]: We got a good thing here. [1:11:42, 1:11:42]: These [1:11:43, 1:11:46]: Millennials, professionals, [1:11:47, 1:11:53]: They got plenty of place to live. It's up to them. Let's let's don't [1:11:55, 1:11:59]: Let's don't destroy the attraction. [1:12:00, 1:12:07]: And give it for some, you know, dream. All right, thank you, sir. Appreciate your time. Perfect. [1:12:11, 1:12:17]: All right, sir, did you sign up already? Okay, go ahead. Come on, sir. Please, name and uh address. [1:12:19, 1:12:36]: Michael Lambert, seven six three nine Glen Devon Road. Um the proposal will put a lot of stress on the infrastructure, whether it be traffic, whether it be crime. [1:12:38, 1:12:40]: Would be far. [1:12:41, 1:12:53]: The area that's there would probably not have any opposition to work commercial, but not to high residential. [1:12:54, 1:12:56]: Where is the city of Stockbridge? [1:12:56, 1:13:00]: Who's gonna enforce this? Is it city of Stockbridge have a police department? [1:13:01, 1:13:06]: Mm. Okay. We we do, sir, but go ahead. W Henry County? You're talking about Henry County, right? No, sir. [1:13:07, 1:13:08]: Go go on with your comment, please. [1:13:09, 1:13:11]: Okay, so you're gonna have them come in and [1:13:12, 1:13:13]: Along with all the other areas. [1:13:15, 1:13:35]: And try to take care of that. There's been a low crime area for a long time. When you bring the transients in, they can't afford it. You're gonna have to evict these people. It's gonna be a turnover like you've had in in many areas in Stockbridge. There are many other areas in Stockbridge. [1:13:34, 1:13:36]: [4417.3, 4418.3]: Bunch of land. [1:13:39, 1:13:41]: This type of proposal can be put on. [1:13:42, 1:13:43]: But why here? [1:13:44, 1:13:53]: Okay, the the area that on Glendevon that I live on, we have lots of residents that aren't here tonight, elderly [1:13:54, 1:13:55]: Disabled. [1:13:57, 1:13:58]: Children. [1:14:00, 1:14:16]: Children play on this area and you have a little road that goes down to this and you're gonna put a fifty foot barrier and just a gate, a fence. Well the fence has been there. There's been a forty foot barrier for years. I've been there since nineteen eighty eight, bought my house there. [1:14:17, 1:14:20]: This is gonna drive property values down. [1:14:21, 1:14:21]: And [1:14:23, 1:14:38]: Where do you go? Where do you go in this um where do these people go when all this crime comes in and the transits come in? You've already had a problem with homeless? You've already had a problem with the traffic. [1:14:38, 1:14:40]: How about try to get on? [1:14:41, 1:14:41]: Go to McDonald. [1:14:43, 1:14:45]: Friday, Saturday, or Sunday, to go eat somewhere. [1:14:46, 1:14:48]: We don't have that type of realm. [1:14:49, 1:14:52]: restaurants and things around here. Side bridge, you have some [1:14:52, 1:15:01]: Just fast foods. Nothing like, you know, what they have in McDonald's. Can you get there? We're not gonna be able to get around to go to the grocery store. [1:15:02, 1:15:15]: Th there's there's just not enough infrastructure to support what you're trying to propose. There's not enough protection to the people that have been there, homeowners that are taxpayers. [1:15:16, 1:15:20]: It just doesn't make sense to overbuild this area. [1:15:20, 1:15:23]: There could be something else done with that commercially. [1:15:23, 1:15:25]: Thank you for the time, sir. Appreciate it. [1:15:31, 1:15:32]: I believe that is it. [1:15:34, 1:15:40]: Ms. Holliday? That's it. Okay. So on on that note, then I'm gonna close the public hearing. I'm sorry, yes sir? [1:15:41, 1:15:47]: There is a rebuttal that is provided in section F and it's about enough to have a bridge rebuttal section. [1:15:47, 1:15:51]: Okay. Quentin? I'm sorry. [1:15:59, 1:16:02]: Good evening, Mayor Council. Since we extended the time, the [1:16:02, 1:16:05]: petitioner who is requesting does get a rebuttal. [1:16:05, 1:16:17]: With the ad with some of the additional time. So she would be allowed a rebuttal. A rebuttal during the public hearing aspect. Is that what you're getting at? Yes. So otherwise I need she needs a rebuttal before I close the public hearing? Yes. Okay. So be it. Miss Battle, come on. [1:16:23, 1:16:26]: Um thank you. There are a couple of things. [1:16:26, 1:16:27]: [4592.3, 4593.6]: Can you do this in three minutes? [1:16:34, 1:16:47]: Well technically I get more than three minutes'cause they got well more than three minutes, but um give me give me a second here to get started. Sure. I know you guys trying to get out of here. Um there are a couple of things [1:17:02, 1:17:22]: There are a couple of things that I wanted to point out with regards to the site plan. One, um, there are two points of entry here. One of the points of entry um is at the stoplight that's off of 138. Um, there's a secondary point of entrance on the other side of the commercial um component of the project that enters, it's a sorry, it's a right. [1:17:22, 1:17:27]: No, it's a actually. [1:17:27, 1:17:47]: Yes, it's a write in and write out only at the other intersection located here. So it's a full service entry here at the light, and then there's a write-in, right-only here at the apartment complex. Additionally, um the assumption would be that all of the townhomes, when you come in through the main entrance, there will [1:17:47, 1:17:54]: will be a roundabout here. All of the townhome units we anticipate will be coming out of this primary entrance here. [1:17:54, 1:18:02]: Um they would not be driving past um the apartment complex to the side. Um additionally um [1:18:03, 1:18:23]: In terms of the um uh uh ability to connect or have a stub out street, we certainly uh have no problem putting the stub out street. Someone will have to cross the stream area here in order to allow that access out. Um we will be responsible for putting sidewalks along the perimeter um in front of the community and um [1:18:23, 1:18:43]: That is not problematic from our perspective. We had been asked before about an entrance from Mount Zion. There simply isn't the ability to do that because of the stream that is between the two properties. We know that the property on the other side is zone C3, which is at a much more intense level than what is currently on this property, which is both C1. [1:18:43, 1:19:03]: And C2. When you look at the types of uses and the amount of acreage that we have here, the amount of traffic that any type of commercial development, if this were built out in its entirety, would have, would certainly be in excess of what we are proposing here, with many more uh trips in and out of this. [1:19:02, 1:19:22]: uh in and out of this property and in my opinion having even more impact um on the adjacent residential community. Again, we believe that this is a suitable transition between the two sites. As far as the rear of the homes that are located adjacent to the property, they will be roughly on [1:19:22, 1:19:42]: 100 feet from the actual improvements in terms of the um apartment buildings. There's a 50-foot undisturbed buffer, and then there's also the trail that we had proposed there, and then there's some additional space before you actually get to the physical building. Um and so with that, um, I believe that pretty much covers. [1:19:42, 1:20:02]: The things that I wanted to make sure of and that I would tried to respond to the questions uh that had been asked by the community. Thank you. Thank you. Appreciate it. Okay, on that note, I will close the public hearing. Uh right, rebuttal was already done. So the public hearing is now closed. Uh now on that note, council, what are the further questions you may have for [1:20:02, 1:20:11]: Um our our Mr. Ryan and or uh the Miss Battle before we take a vote. Yes, sir. Go right here, please. [1:20:13, 1:20:17]: Uh Miss Battle. See there's there come on back. [1:20:18, 1:20:38]: There was some uh uh originally there was some confusion about uh being able to make a left-hand turn out of this development. And I think we clarified that there will be a full functioning traffic light with a full left-hand turn out of the development. Is that correct? That is correct. Okay, so if you're coming out of this [1:20:38, 1:20:43]: development you will be able to turn left to go toward I seventy five, is that correct? [1:20:43, 1:20:45]: That is correct. At the light only. [1:20:45, 1:21:05]: Okay. And in terms of the last question is in terms of the overall economic investment, I think this development represents about a hundred million dollars in investment. Absolutely. Absolutely. Along with the commercial, yes. Along with the commercial. All right, thank you. No problem. Council, any other questions? [1:21:05, 1:21:16]: Ms. Battle. Yes, sir. Um I would I I've been trying to research the land and the [1:21:16, 1:21:19]: um status for his development. [1:21:20, 1:21:23]: So the question I want to ask you [1:21:24, 1:21:26]: So if this issue here [1:21:27, 1:21:31]: Before this issue, let me start that way. Before this issue. [1:21:33, 1:21:50]: This property would have been able to uh without any public hearing, whatever, uh a developer would have been able to come in and just build some apartments. I may not have phrased that in the proper language. [1:21:50, 1:21:54]: But do you sort of get the the understanding where I'm trying to go with this? [1:21:54, 1:22:02]: I don't know that it could have been developed immediately for apartments. I don't think the overlay it's commercial is true. Uh it's commercial. So the property [1:22:03, 1:22:05]: Is that [1:22:06, 1:22:24]: Okay. I will let my client respond to that. The land use plan of land use. Yes, from a zoning perspective sorry. From the zoning perspective, the overlay district from a underlining use allowable would allow us to do minimum two stories. I think it was on up to [1:22:25, 1:22:45]: eight or nine stories with first floor retail and a much more dense proposition that we're proposing. Um so yes, by by the overlay allowing the code change did allow us to do a much more dense project with a much higher height with other uses than what we're proposing, if that's what you're asking. Well I'll try to clear my [1:22:46, 1:22:49]: Now I was trying to get a picture of [1:22:49, 1:22:52]: What would have been allowed [1:22:55, 1:23:03]: What would have been allowed on this property if we were not going through this process right here, right now? [1:23:04, 1:23:06]: 'Cause I'm and I guess in my mind [1:23:08, 1:23:15]: You could get this or you could get that. So I'm trying to get the understanding of [1:23:17, 1:23:24]: What type of development could actually come right now? I understand what the citizen don't want. Sure. [1:23:24, 1:23:30]: Okay. But what would be allowed without that decision actually coming? [1:23:31, 1:23:51]: So when we review the current underlining code and the overlay, the overlay allowed for it could be quite frankly almost all rental apartment type use. That's that's that's what I was trying to get to. Yes, sir. And and the densities were much greater than we wanted to propose. One, because we felt that creating fifty two percent [1:23:51, 1:24:07]: Green undisturbed on this fight plan. One was more attractive, um, and two, we thought it was a better use for residents that are living in it. So at this point, before um this council voted, even before it came to us. [1:24:08, 1:24:10]: It could have gone all rental. [1:24:10, 1:24:17]: Yes, sir. That's an understanding of the overlay. It could have gone all rental. Yes, sir. Okay. That that's ought to answer my question. [1:24:18, 1:24:24]: Mayor. Stand stand by please. No stand by. No, no. You're you're fine, sir. Mr. Blount, go ahead, please. [1:24:25, 1:24:28]: Um I just wanna be clear is that [1:24:29, 1:24:37]: Every development comes through our planning and zoning. Every development comes through this council. What's allowable? [1:24:38, 1:24:50]: Um everything comes through this council for approval to be built. No one no project can come and just build in the city of Stockbridge. Let me just make that clear. [1:24:51, 1:25:11]: Um I don't have a whole lot to say because I've always and and m my my thing is I've I've I've I've got a problem with the uh the uh rental piece. And if anybody wanna know what I said you can go visit the last meeting because we're basically doing the same thing from the last meeting and my decision hasn't changed. So [1:25:11, 1:25:12]: So that's why I stay. [1:25:13, 1:25:15]: Thank you. [1:25:15, 1:25:25]: Um, I'm a little confused i if the gentleman can come back up because he but he made a statement in regards to what could be built, but we are voting right now [1:25:26, 1:25:37]: Um this this agenda item is to change from low low density to high density. So there's no way that we could have even more higher density if [1:25:38, 1:25:41]: if we have to vote right now to change it from low to high. [1:25:41, 1:25:59]: From my understanding, low density could have been two story unit apartment complexes and it wasn't financially feasible to do. And now you're saying that you could bypass all that if we didn't vote today and just put a whole bunch of apartment complex units up, which makes absolutely no sense to me. [1:26:01, 1:26:21]: So can I clarify on that? The property is located in the Parkway mixed use overlay district. And under the overlay district, um it indicates that um the permitted uses or any combination of uses permitted in C one, C two, OI, C C R and M F R, which is your mixed use, are presented in [1:26:21, 1:26:41]: In the overlay district. And so when we look at the MFR district, that is that was your mixed-use district. That is now the multifamily residential district as set forth in your code, in the currently adopted code. And under that, [1:26:40, 1:27:00]: MFR is mixed use and it allows for and I'm on page 32 of the code. Um it allows for triplexes, quadr quadruplexes, apartments, townhomes, condos, and senior housing. Um it gives what the minimum [1:27:00, 1:27:20]: Acreages, which is two acres, maximum height structure is 45 feet, and it has the living requirements here. So apartments are currently allowed in the district. It also mentions here that the previous highway 138 overlay district has been a limited. [1:27:20, 1:27:40]: Eliminated as a separate district. The previous high-rise mixed-use overlay district has been eliminated as a separate district, and two mapped areas which comprise the two districts are no longer recognized. And it has some more language in here. Any high-rise building or mixed mixes of uses which are located in the parkway mixed-use overlay districts shall meet the associated additional. [1:27:40, 1:28:00]: standards which previously comprise the high-rise mixed-use overlay district. So there's no question that apartments under here, unless there was something else discussed a second ago, that those are allowed within the statement that says the mixed use overlay district trumps. Yeah and it says that the misuse [1:28:00, 1:28:18]: overlay district trumps everything else, the underlying zoning. And here in building standards it says height requirements. Maximum building height standards, 20 stories, minimum of two stories, the first finished floor level being level with um the sidewalk grade. So that's what's allowed under here currently. [1:28:18, 1:28:38]: Okay. So what would prevent you guys from doing that at this point in time? Technical um technically there's a statement in the in the UDC under the Parkway mixed use overlay uh district um that gives the park [1:28:38, 1:28:57]: Parkway mixed use overlay district um precedence over the base over the underlying zoning. The underlying zoning is C one, C two currently, but the parkway mixed use overlay takes precedence over that. The requirements of the parkway mixed use overlay or dish district allows basically what they're proposing. [1:28:58, 1:28:58]: Okay. [1:28:59, 1:29:00]: Because [1:29:01, 1:29:21]: The overlay. Is it a proposed overlay or we actually have a overlay? We actually have an overlay. It's it's was introduced in our new uh UDC on March the fourteenth. Okay. So they can come reconfiguring um basically develop their project. It was introduced in the UDC. Yeah, and in March it was adopted on March fourteenth, the new UDC. Okay. So the [1:29:21, 1:29:34]: Parkway mixed overlay district takes precedence over the C one, C two zoning and it and and the PU PUD zoning. Okay. So what's allowed in the Parkway Mix Use Overlay District is or what is basically what the high rise. [1:29:34, 1:29:49]: Yeah. So what is preventing you guys from doing the high rise? Can they go lower than the high rise? Uh yes, they can go lower than high rise. Okay. And w and how low can they go? It's two stories. Two stories. Yes. Mm-hmm. [1:29:49, 1:29:51]: Right. So [1:29:51, 1:29:56]: So you're saying that they have the right to do this right now? Uh yeah, in some format. [1:29:56, 1:30:01]: without us changing this from low density to high density. [1:30:03, 1:30:13]: I would need to research that uh uh and run it by legal but that statement that gives the Parkway mixed use overlay district uh presidents over the underlying zoning, I think so. [1:30:14, 1:30:16]: If they could do it right now, why are we here? [1:30:17, 1:30:18]: Legal. [1:30:18, 1:30:36]: I think there legal. I mean but you didn't see this statement before y'all supply. No. Okay. So with regards to the project is currently approved or allowed under um the um [1:30:37, 1:30:40]: The overlay district. [1:30:43, 1:31:03]: Okay. Um issues over there steel has uh the statement steel says it takes president quite a while. Right. So no, I think the question is why aren't we just developing it as it under under the current regulations? And I think that um the issue is really about the ability to lay the the project out in a way that we feel is [1:31:03, 1:31:23]: Marketable for the development. And so I think that a lot of what the county's stuff had contemplated were designs, particularly with a lot of retail on the first floor and high-rise apartments above. And so what our plan was. [1:31:23, 1:31:43]: was was to provide for the um the commercial component of the project um up front um and then have the mixture of both the townhomes because we wanted to provide a mixture of units. We did not want a hundred percent apartment related uh community. And so based on our interpretation, [1:31:43, 1:31:57]: we felt that we needed to come through this process to rezone in order to allow us to do both the retail, the townhomes and the apartment units and not all in one building, basically. [1:31:59, 1:32:09]: All right. So um let me see here. Any additional comments, um mister Ryan or or just attorney here. Any anything additional, ma'am? [1:32:11, 1:32:27]: The only thing that I can add to that is it sounds like from what Ms. Battle just stated, it was their decision to apply and go through the rezoning process um based on I guess the project that they're trying to do. Clearly the ordinance does have an overlay that allows for [1:32:27, 1:32:33]: those requirements under the overlay district to take precedent under over the underlying zoning. [1:32:34, 1:32:34]: But [1:32:35, 1:32:41]: They chose to apply and go through the rezoning process, I guess, based on the development that they're trying to get approved. [1:32:41, 1:32:50]: So the overlay is requiring that commercial be on the bottom floor and living space be up top, correct? [1:32:51, 1:32:54]: And I remember talking about that a couple of years ago when [1:32:54, 1:32:58]: that we w wanted to see more of that. There was a ongoing trend of that. [1:32:59, 1:33:00]: So [1:33:00, 1:33:04]: This would be where the commercial would be separate. [1:33:04, 1:33:06]: From the living [1:33:06, 1:33:26]: arrangement so you basically have a subdivision with some townhomes and then you have another area with apartment complex and then you appease us by putting commercial pla units in the front, a couple of c commercial spaces. Um and I have a concern about that because [1:33:26, 1:33:29]: 'Cause that to me is not the intent of [1:33:29, 1:33:32]: where the city was going with that overlay. [1:33:32, 1:33:37]: So my question was, why are we doing this if they could build [1:33:38, 1:33:44]: Well, their apartment units. Bec is that because they can't build the apartment units [1:33:45, 1:33:47]: without the commercial being on the bottom. [1:33:47, 1:33:56]: No, it's it's a greater macro. Does it restrict? It's a greater macro issue. You all have to change the comp plan to assume the density for the development. [1:33:57, 1:34:12]: Th well I thought so, but that doesn't seem like what they're saying. Yeah, that's what we're doing. We're changing the the comp plan has Is that has does it have to match? Do we have to change the comp plan? When I was just told that they can build right now with as much as they want. [1:34:13, 1:34:17]: The comp plan doesn't assume the building, we're trying to have the two line up accordingly. [1:34:18, 1:34:28]: And that's the decision that you all have to make with the comp plan. Because that's that's why we're here on the that's why we're here on the amending of the comp plan. So what happens if the comp plan [1:34:29, 1:34:36]: isn't amended, they still have a right to build the apartment units. Well you have a legal at that point you all have a legal question. [1:34:37, 1:34:44]: Well let me just say this. Under the multiple family residential district. Good, could you come to the mic, please? I'm sorry. [1:34:45, 1:34:56]: It does say in the language in the ordinance is the city should promote an average density of fourteen dwelling units per acre or higher. It sounds like to me that they are [1:34:56, 1:35:03]: are asserting or trying to get a density that is not that high. So from what I am [1:35:03, 1:35:08]: Observing and hearing tonight. Repeat that again. Let me hear that again. [1:35:08, 1:35:21]: The city should promote an average density of fourteen dwelling units per acre or higher. So in this residential district, the MFR overlay, and correct me if I'm [1:35:22, 1:35:29]: misstating that, but just reading from what the ordinance is saying, it looks like it does allow for a higher density. [1:35:29, 1:35:49]: Parkway mixed use over the edge. But the but the issue is is the uh comp plan. The comp plan is still is in conflict with the UDC. The the land use designation currently is low use, low density, mixed vertical mixed use, and therein lies the conflict. [1:35:49, 1:35:51]: I get that part. [1:35:51, 1:36:11]: So the issue is we need to change the comp plan so they can build a project the way that they're proposing. If not, they will have to reorient their project, their proposal to meet the current comp plan standards, which was which is typed out at like two two units per acre. [1:36:11, 1:36:21]: But the m but the conflict here is is the the land use designation. So they need to go up to high density residential in order to build is what they're proposing. [1:36:23, 1:36:25]: [5786.7, 5788.6]: Yes, no comments, sir. Go ahead. Go ahead, please. [1:36:30, 1:36:42]: I I just want us to continue to make things clear rather than put a perception out there. Okay. The perception has been what you can do, which we're saying that you can't do. [1:36:43, 1:36:46]: And the conflict can be easily [1:36:46, 1:36:47]: Um [1:36:48, 1:36:59]: fixed by just saying, for lack of a better term, by just l saying that s when we did the comp plan for this, when we talk about our un you know, unif uh unified development, when we did the comp plan [1:37:01, 1:37:05]: To come and put to perception that everybody's okay with this. [1:37:06, 1:37:10]: We this council agrees to the comp plan. [1:37:11, 1:37:13]: And so to come to us is [1:37:14, 1:37:31]: And now that changes have to be done to comp plan, I don't want a perception of something that could have been done, which can't be done, because we do have a comp plan in place. And when you talk about Miss Bell, how you doing and when you I see your H's right now. Uh and when you talk about [1:37:31, 1:37:51]: The mixed use versus you can't you could not come in there and just build apartments. And I don't want that perception put out there. You couldn't do that under the current comp plan because mixed use plan under the comp plan trumps that which which you just you just stated that. I'm only s restating what you stated. [1:37:51, 1:38:11]: Use overlay district, trunks, the other body trunks. So the parkour district use overlay district allows a combination of like four different uses. It allows C1, C2, OI, CCR, and MFR. And MFR is our multi-family zone district. [1:38:11, 1:38:31]: Most of the families in the parkway mission solar industry. Okay. But the issue is the density. At what density can they go in and build apartments? Can they build at six units per acre now? Without you guys approved? That's the question. I don't think so. I think the density has to be changed. [1:38:31, 1:38:51]: In order for them to build their their uh uh their project is current in in its current form. So I think the issue and the reason why we're here right now is for a land use amendment for the for the density apartment. They can build apartments right now, but not at the density they are currently proposing. Right. So that's that's that's the [1:38:51, 1:38:52]: That's the bottom up. [1:38:52, 1:39:07]: No, no, I get that. But I don't ever want a perception put out there that they could come and build this sir without any changes. Yeah, there is um uh we we switch lady to uh starting out updating our cunt plan right now. [1:39:07, 1:39:25]: Right now we have a new UDC, a new zoning ordinance that was just introduced in March. Right. Which can which kind of contradicts our current comp plan. Our current comp plan is older. So once we update our comp plan, it will match this perfectly. Right now, the comp plan is a little outdated. [1:39:26, 1:39:40]: So I mean I'm just saying in mild sense, but this this was updated in March and the c and the comp plan will be updated later on this fall to match this in its entirety. Right now there are some conflicts in the zone edition. [1:39:42, 1:39:45]: Okay. Ms. Barber, I think you had your hand up earlier. [1:39:48, 1:39:50]: I did. Um and [1:39:50, 1:39:55]: Forgive me, but I am comp I'm confused now. I know that we are [1:39:55, 1:39:58]: The request is for us to change. [1:39:58, 1:40:04]: the land use map designation from low density to high density. [1:40:04, 1:40:05]: Correct. [1:40:06, 1:40:11]: That's correct. If I can try and add some clarity here'cause I can understand the confusion. [1:40:11, 1:40:27]: Okay. So Okay. A as a and and I'm happy to try and clarify and if the attorney for the city wants to um make a statement thereafter that's fine as well, obviously. To your [1:40:27, 1:40:28]: Yeah, that'd be fine. Go ahead. [1:40:29, 1:40:37]: Okay, so the property currently has a zoning designation of C one, C two. [1:40:38, 1:40:45]: It is in an overlay district that allows for uses that are in addition to. [1:40:45, 1:40:46]: The C one. [1:40:47, 1:40:52]: Um and that was something that you all recently approved in the current zoning ordinance. [1:40:54, 1:40:59]: As far as the land use is concerned, I'm gonna have some differing of opinion with staff. [1:41:00, 1:41:20]: A land use plan is the vision that the city had provided back in 2018 for the property in the area. And typically with land use plans, what it means is that if you are currently zoned something, let's say you're zoned C1, but the land use plan says [1:41:20, 1:41:36]: it's residential. The zoning trumps the land use plan. You're still allowed to develop your p your property in accordance with whatever that C one is, unless your zoning ordin specifically, like for example, Cobb County, [1:41:36, 1:41:38]: [6098.6, 6099.0]: That [1:41:39, 1:41:39]: Your [1:41:40, 1:41:46]: Zoning has to match your comp plan, otherwise you cannot develop. [1:41:47, 1:41:50]: That is not, to my knowledge, in your zoning ordinance. [1:41:51, 1:41:57]: Which means that the comp plan comes into play when I seek to rezone a property. [1:41:57, 1:42:02]: If I rezone it, now I have to rezone it to a designation. [1:42:03, 1:42:23]: that is allowed under the comp plan. So your comp plan has specific zoning districts that you can rezone to based on whatever the underlying land use is. So for instance right now with low density, I can't rezone to the PUD and get the density that I want. [1:42:22, 1:42:28]: I would be left at that low density vertical mixed use. [1:42:30, 1:42:46]: What my client made a decision and what the decision was made with regards to us and why we sought rezoning. Right now, yes, we could build an apartment. We could build a twenty it says twenty um uh story building right now, if that's what we chose to do. Now [1:42:47, 1:42:55]: In the most likelihood, is anybody gonna come in here and put a twenty-story building on that particular property? No, I don't even know why you all put it in the ordinance at twenty-stories, but hey, it's there. [1:42:57, 1:42:57]: D [1:42:58, 1:43:10]: Intent there um apparently was to have kind of this mixture of retail um with first floor residential, I mean first floor um [1:43:10, 1:43:20]: commercial or retail and then um units above. That particular configuration is very much of an urban configuration. [1:43:20, 1:43:39]: Um and we certainly understand the push towards that, but quite honestly, within the area, there hasn't really been any of that type of development happening. Even across uh within Clayton County and in Henry County, there has been challenges getting that type of a product built. And so what we thought was better from a couple of different perspectives. One [1:43:40, 1:43:55]: Under the current zoning, we could build a lot more units. If we went with that configuration, you could simply have m up to 14, as it indicated in uh, as the staff indicated, you could have up to 14 units per acre going up. [1:43:55, 1:44:14]: And nobody would have to come in here and ask this community or anybody else anything. All you'd have to do is come in here and comply with your overlay district and you would get that density and one day you would look around and it would be there if somebody is willing to come in and develop that. If your economic development department or whoever is trying to get someone to come in, they could just do that tomorrow. And there would be nothing to be said about it. [1:44:15, 1:44:20]: What my client said is we don't want to build that much density, number one. We don't want fourteen units per acre. [1:44:21, 1:44:24]: We would prefer to build something much less intense. [1:44:25, 1:44:27]: at no more than six units per acre. [1:44:28, 1:44:43]: And so that is what we have presented to you. We presented a plan that has less density in it at six units per acre, but it is not above retail. Let's just be candid. It is not above retail. We have forty thousand, however, square feet of retail. [1:44:44, 1:44:50]: So we don't have just like a little bit of retail. At 40,000 square feet, that's a significant amount of retail. [1:44:51, 1:45:10]: So retail service that can be used for a park for um restaurants, um other businesses, um local businesses, national businesses, but that's a good amount of retail that we have. Additionally, we have the single-family detached townhomes at 128. [1:45:10, 1:45:13]: And then we also have the apartments. [1:45:14, 1:45:25]: So we asked for a project that was less intense, even though we have to go to the high density residential land use designation, which is kind of crazy because I can't tell you any county in which [1:45:26, 1:45:29]: or city, six units per acre is considered high density. [1:45:31, 1:45:34]: In most places six units per acre is [1:45:34, 1:45:39]: medium density, it is not considered high density, but your land use [1:45:40, 1:45:53]: um plan actually has in my opinion kind of a gap because it goes from 3.6 units and then it jumps to six. There's just no in-between. So that's a a I hope something that you all will fix in your new comp plan. [1:45:53, 1:46:06]: So that's why we're here today. Um we are seeking and and it put more onerous on us, quite honestly, because we had to come before this board and ask for this zoning change to basically build less [1:46:07, 1:46:09]: But just in a different configuration. [1:46:09, 1:46:28]: and put forth the comp plan change in order to allow us to do that. Whereas if we just wanted to come in and just build and not talk and have any challenges or issues, we'd have just came in here, built over, you know, however many units we needed to build over that retail and and been at peace with that. So that is where we are. [1:46:29, 1:46:35]: Thank you. Thank thank you but stand by please. And Miss Barber, that was our last question. Are you done or do you have more questions? [1:46:35, 1:46:39]: I do have um several questions. So [1:46:39, 1:46:44]: With this request um to change the Ms. Valley, you may have to come back, please. [1:46:44, 1:46:48]: With this request to change the future land use designation. Um [1:46:49, 1:46:53]: Again, in my mind, considering high density [1:46:53, 1:46:58]: Um I would expect that there will be multiple access points. [1:46:59, 1:47:02]: With this particular project, there's only two. [1:47:03, 1:47:06]: And they're both on highway one thirty eight. That is a concern for me. [1:47:07, 1:47:09]: What I'm considering high density. [1:47:09, 1:47:10]: I'm thinking about [1:47:11, 1:47:12]: A mall. [1:47:12, 1:47:16]: There are multiple access points, and I know with um [1:47:17, 1:47:18]: That particular [1:47:18, 1:47:19]: Area [1:47:19, 1:47:23]: We're gonna be looking to develop and bring in more developers. [1:47:24, 1:47:27]: And people need to be able to traverse. [1:47:27, 1:47:29]: Throughout that block. [1:47:29, 1:47:35]: Commissioner, we we only have the frontage that we have. We only have frontage on one road. [1:47:35, 1:47:55]: And if another builder came in here and didn't have to come through this process, the only places they would have access are the same places that we're going to have access, whether it was developed for C1 or whether it was developed for a 14 unit per acre high-rise community. We still only have the access points that we [1:47:55, 1:48:00]: [6481.1, 6496.3]: um a a stub out for the extra stuff. The bottom line is it's going into the back of an already established retail um community. And then on top of that, I have still have no frontage on the public right of way on the back end of the project. I can't [1:48:16, 1:48:18]: I can't create something that I don't have. [1:48:19, 1:48:21]: And so the density [1:48:21, 1:48:41]: You know, we think of density, but we don't think about how much if it were just built as a regular commercial development, it's gonna have a significantly more amount of traffic. Because even a traffic engineer will tell you that the traffic that a commercial project brings is higher than what a multifamily project would bring. [1:48:41, 1:49:01]: And we're not high density, we're not at 14 units per acre, we're at six. There are single family detached subdivisions that are being built at a much higher density than what we're proposing. I've got projects going in in other parts of the area that are going in, not in Stockbridge, but are going in at eight units per acre. [1:49:01, 1:49:06]: This is six units per acre with a multifamily with both townhomes and apartments. [1:49:07, 1:49:14]: If we just looked at how much the apartments were at a a um number per acre, we'd be even less than six units per acre. [1:49:17, 1:49:20]: Thank you for that. I'm thinking in terms of [1:49:21, 1:49:22]: People who will move there. [1:49:23, 1:49:25]: If they want to go to Coles. [1:49:26, 1:49:32]: They should be able to access coals other than to walk along one thirty eight or to drive. [1:49:32, 1:49:34]: one thirty eight to get there. [1:49:34, 1:49:38]: So a stub out was one option I didn't speak with. [1:49:38, 1:49:43]: We have no problem with this stuff, Alex. Okay, so I would suggest two of them. [1:49:43, 1:49:57]: One at the three o'clock point and another one at a six o'clock point. That's fine. And if they if if at some point they wanna connect into it, we don't have a problem with that. We don't have a problem with the stub out. It's who's gonna cross the who's gonna cross the stream is gonna be the question. [1:49:59, 1:50:02]: But we'll we'll do the stub out on our side. [1:50:02, 1:50:10]: But we can't go onto another person's property. We only own to a certain point on the stream. I understand that. Thank you. Okay. [1:50:11, 1:50:17]: Is that all your questions? That's all I have for now. Sir. Okay. Well stand by. Mayor Potem. Mrs. Battle. [1:50:18, 1:50:30]: Uh I I just y I'm not asking the question. Uh uh the question that I asked originally, um I had read, I had studied, you know, the new UDC and and [1:50:31, 1:50:44]: I was somewhat confused with that and didn't know how to pose the question. But you did answer my question and what I was trying to understand, because of the code, the way it is right now, [1:50:44, 1:50:57]: uh a developer can come in and apply and go through the process and build without hearing et cetera et cetera and and that's what you said and and that's what sort of concern me [1:50:57, 1:51:01]: Uh because someone a developer can come in right now. [1:51:02, 1:51:05]: And just do just that. Correct. And that would be something [1:51:05, 1:51:25]: I would not want for sure. So and that's the question I was trying to articulate because when I read it it was a little confusing, but in my mind I sort of understood that and I couldn't uh pose the question. But you did answer that. And for me, um that is very important. That is very important. And I just want to say uh thank you. [1:51:25, 1:51:31]: for that now I do have a better understanding of just that. Thank you, Mayor. Stand by police, please. Hold on. [1:51:32, 1:51:35]: Go ahead. Uh couple now's on it. Yeah, Ryan, can you come back up? [1:51:41, 1:52:01]: I think you said something that was really important, which was our procedures are out of whack. Which y w w when you said l let me let me state that away. When you said that we approved the ULDC and the we haven't changed the comp plan yet. But when we do change the comp plan [1:52:01, 1:52:21]: It will match up with the ULDC. Is that what you said? Yes, sir. That's it. That's it exactly. Yes, sir. Right. So that's what I'm saying. So later on this year, if a developer comes in with this exact same scenario, the UF the comp plan will already match up with what's going on. Basically, they got caught into the wicks of before we were. [1:52:21, 1:52:41]: Are able to update the comp plan, the future land use map. Yes, sir. If if the council votes to adopt the new proposed comp plan, yes, sir. Absolutely. That that that's what I'm saying to you. But basically that's what you that's what you said, correct? Yes, sir. And then I want to clarify a point, Ms. Battle made, which was there are single family subdivisions. [1:52:41, 1:53:01]: Divisions right here in areas you've been in planning and zoning a long time, that they're building single family homes. And I think our definition of high density is basically we're using high des high the desk the definition of high density at six, where other [1:53:01, 1:53:17]: jurisdictions are using that level of six and medium density. Is that correct? That's true. Um at certain places I worked they had a district called R6, which was six units per acre, single family detached residential. So and that was considered low density. [1:53:17, 1:53:32]: Right. So in as in other words, our definition of high density is not consistent with what other jurisdictions are, which is our six number is really medium density in in other jurisdictions. That's correct. All right, thank you. [1:53:32, 1:53:37]: Mr. Blott, go ahead please. You good? All right. Any other questions from anybody else? [1:53:40, 1:53:41]: Uh I don't know what music. [1:53:41, 1:53:51]: Ms. Battle. Well we're talking about the interest of the coal that stream. Is that uh is that considered wetland where d the Corps of Engineers has to get involved in order to do any development across that? [1:53:56, 1:54:16]: So there is the stream buffer that we cannot encroach into. Any crossing of that stream, you can get a perpendicular crossing. Um, but we only own on our side of the stream, so there's property owners on the other side, and then um because that stream is not at the um right-of-way, then you have to cross over somebody's property to put in [1:54:15, 1:54:18]: in a whole that basically you're putting in a street. [1:54:18, 1:54:24]: By putting it over there. So I'm reading I'm saying it'cause you could put anything in on your property. [1:54:24, 1:54:30]: I can I cannot encroach into the stream. [1:54:30, 1:54:40]: Would be that's a whole totally different situation. So you can say, Yeah, we'll put whatever in on our end, but there's no encroachment can happen to that stream. It's a it's a longer process to deal with that. Is that correct? [1:54:41, 1:54:56]: So I'm gonna put up here, I think I can turn the side plan. So all of this here is the string on our side. To the extent that we put a stub out, we can stub, you know, along this perimeter. [1:54:57, 1:55:17]: Does it make sense to stub? I don't know that it does because I don't know who's gonna cross the stream. There's a significant kind of drop as you're moving towards the back end of the property from a topo perspective. And then you'd have to, it's almost like you'd have to build a bridge over the um over the stream because of the topo. And then you can see here. [1:55:17, 1:55:19]: that this area back here [1:55:20, 1:55:24]: Are you using a pointer or something? I don't see if you got you got Oh wait a minute, hold on, let me see if I can [1:55:25, 1:55:30]: Let me see. Well, it doesn't allow me to point. Uh let me see if this [1:55:31, 1:55:32]: Yeah. [1:55:33, 1:55:50]: I'm sorry. I'm trying to point, but it doesn't allow me to point. Did you exit or something? Huh? Or did you exit? Okay, let me exit your view. Okay, let me try and do that then. Uh insert. Okay, let's try this. [1:55:52, 1:55:53]: Oh there we go. [1:55:54, 1:55:58]: Thank you. All right, so um this is the stream here. [1:56:00, 1:56:20]: And so if we cross over the stream, you can see that we don't have anywhere to go. If we crossed over back here, we would be going into this complex here. If we went uh over in this area, um again, this is land. [1:56:20, 1:56:30]: that we don't own. Um one option obviously is uh asking for interconnectivity. Now f in my opinion what the city could do [1:56:30, 1:56:46]: um and it may already be in place, I'm not sure, is to ask for any of the lots along here to have interconnectivity because that would then allow a stub out so that anybody could come out. Like for example, we've got um [1:56:47, 1:56:51]: This area right here. Well we could have a stub out that it would allow [1:56:51, 1:56:59]: For entry into this property, which is being subdivided, and then ask for all of these properties along this frontage. [1:56:59, 1:57:19]: To have interconnectivity so that you could literally go from this side of the community across here and never come out on the on the on the right-of-way. That to me would be best for everybody because I would take people off the road and have everyone coming through these properties. [1:57:19, 1:57:30]: properties to get here. And so anybody that's developing would have to have that connection to get you over to this unit here. [1:57:31, 1:57:47]: I just like I'd just like to add one extra point that we do have a sidewalk and trail plan upcoming. So it will address some of these issues that um Council Member Barber's concerned about and what Ms. Battle just spoke about. So we we have a plan on con uh for future connectivity through sidewalks. [1:57:47, 1:58:00]: Thank you. Appreciate it. We're also talking about uh uh and I think that's great too, but I think your concern was vehicular. You know, if I'm gonna drive if I i uh right now I have to drive around if I wanna get the coals. I might walk, but if I'm lazy [1:58:00, 1:58:20]: Like probably me. I I probably be driving around to Kohl's. So the question is how can I get people to Kohl's without getting on the street? And that's that interparcel connectivity. You've got one, two, I think three, four um parcels here that you can require to do that interparcel connectivity. Everybody has to allow [1:58:20, 1:58:26]: for that access easement across their property in order to get to the properties on the other side off of Mount Zion. [1:58:27, 1:58:30]: Thank you. Council, any other further questions? [1:58:31, 1:58:35]: If not, then I need a motion to accept this uh change in this for a comprehensive plan. [1:58:36, 1:58:56]: Yes, sir. Okay. You make a motion, sir. I want to make a motion based upon uh what council Councilwoman Barber's recommendation was for the interconnectivity to the surrounding so people do not have to go out into the uh highway one hundred thirty eight in order to access uh the surrounding development. [1:58:56, 1:59:09]: That's a very good uh suggestion, uh along with the stub outs and all the requirements that uh sh she had mentioned in terms of uh the wants in terms of improving this development. [1:59:11, 1:59:12]: Is there a second to that motion? [1:59:13, 1:59:16]: Mayor. Yes, ma'am. Point of order. I think we need to [1:59:17, 1:59:19]: We we first have to approve [1:59:20, 1:59:21]: We have first have to go [1:59:22, 1:59:28]: about this order of changing from low to high right before we can even discuss any changes. [1:59:29, 1:59:31]: On the development plan side, we have [1:59:32, 1:59:43]: Okay, understanding obviously in at that particular request deals with other property owners, we have no idea who they are at this time and and and whether or not they even would even comply with that too is another thing to think about. But okay. [1:59:44, 1:59:52]: Right. I'm saying that on our agenda. Yes. We haven't amended our agenda to add any additional motions or conditions. This is not [1:59:52, 1:59:58]: This is not what we're talking about. Right. Our agenda item is in regards to whether or not we're gonna vote. [1:59:59, 2:00:04]: for the to change our comprehensive plan amendment from low density [2:00:04, 2:00:15]: vertical mix shoes to high density residential. Okay. That was totally something totally different. That's wanting to talk about the design [2:00:15, 2:00:20]: of the actual apartment complex. Right now we are we should be motioning on the [2:00:20, 2:00:25]: what's on the agenda item. Right. That we approved and adopted at the beginning of the council meeting. [2:00:25, 2:00:45]: Okay, good point. So I ask that we remove that motion. Well the motion has been seconded, but Mayor, let me ask a question. I want to ask legal. I don't think it's whether these stand by place. Whether Ms. Gamp makes the point. I want to ask legal whether these conditions pretty much you can make a motion at any point during the council meeting in order to make changes that you want to make. [2:00:45, 2:00:51]: make so and we the conditions are allowed on any zoning. So is that appropriate? [2:00:53, 2:01:13]: I do agree that for purposes of this agenda item, it is just about the CDP and density. If it is the will of council at the next agenda item that's dealing with the zoning, the rezoning, if you want to implement your suggestions as zoning conditions, you can do that in your motion. But for purposes of what [2:01:13, 2:01:20]: What's before you right now, it is just a density, and whether or not you choose to amend these the um complex. [2:01:20, 2:01:26]: Thank you for that clarification. Appreciate it. Okay. Based on the political interpretation. [2:01:26, 2:01:41]: Based on what was just recited by legal, I make a motion to approve uh the comp plan uh amendment uh as uh suggested by the zoning advisory board and the um city staff. [2:01:42, 2:01:43]: Sir, second emotion. [2:01:44, 2:01:44]: A sec. [2:01:45, 2:01:48]: Okay, second by Mayor Potem. Are any further discussion? [2:01:49, 2:01:51]: All in favour, please indicate. [2:01:53, 2:01:55]: I'll pose. [2:01:57, 2:02:08]: Abstain. Oh I'll be done. Mayor. No, hold on a second. Hold on. I it's too too w stand by, sir. I I I I'd like to change my stand by. [2:02:09, 2:02:11]: It's two two one. [2:02:12, 2:02:16]: Mayor, I'd like to change what I'm getting ready to say before you take the vote count. [2:02:18, 2:02:21]: Stand by a second, please. Attorney. [2:02:22, 2:02:23]: We got a two two one. [2:02:24, 2:02:30]: All right. That two two one allows me stand by will you stand by, sir, please. Mayor, we're not gonna go off of that. Stand by. [2:02:31, 2:02:37]: Allows me to vote. Now this gentleman wants councilman wants to change seems like he wants to change his vote. [2:02:37, 2:02:43]: Now we have you know, with the vote is taken, he wants to change his vote. Not knowing which way he's gonna change his vote, but he wants to change his vote. [2:02:44, 2:02:45]: Can we do that at this point? [2:02:51, 2:03:11]: So the vote that was just done was per the motion that was put on the floor. That's correct. So that needs to be either seconded or it wasn't so then it just goes forward as the motion was was articulated by the motion maker. So if the vote was two to [2:03:11, 2:03:15]: two one, that's the vote per the motion that was put on the floor. [2:03:15, 2:03:16]: Okay, got that. [2:03:17, 2:03:20]: What I'm saying is the question at hand is. [2:03:20, 2:03:22]: When I raised my hand. [2:03:23, 2:03:24]: My hand was taken. [2:03:25, 2:03:26]: As a no vote. [2:03:28, 2:03:32]: When that's what I'm trying to tell the mayor. My motion is not a no vote. [2:03:32, 2:03:35]: My no my motion my my hand is an abstention. [2:03:36, 2:03:43]: It's not a no vote. Okay, so it's the intention of of the voter. So if that was your intention, then that's how it should be counted. [2:03:43, 2:03:51]: All right, this now and you're staining for I mean there is a conflict in interest here on this vote. That's why you want to I do not have to explain that to you, Mayor. [2:03:55, 2:03:57]: All right, so now this [2:03:59, 2:04:02]: Mr Quinton, Mr Washington, you have any further comment on this at all? [2:04:02, 2:04:07]: Mr. Stamp Stand by sir. The clerk is trying to get your attention. I'm sorry. [2:04:08, 2:04:09]: I'm sorry, Clerk, go ahead. [2:04:12, 2:04:13]: I'm I'm sorry. [2:04:20, 2:04:21]: Ms. Clerk, you had something? [2:04:22, 2:04:23]: Oh yeah. [2:04:25, 2:04:36]: Let me clarif let me clarify this with you, the clerk. When I tried to tell the mayor my vote was for extension, when I raised my hand, the mayor declared my vote as a no. [2:04:36, 2:04:56]: I I did I did declare you declared my vote as a no. Okay, I'm gonna tell you that's why I kept trying to tell you my vote is not a no. The presiding officer point of order presiding officer. Stand by. I've declared it a no because because that's what I saw. Your hand go up as a no, sir. I saw that as a no. That's what I saw. When I said that, your hand went up. Stand by. Mr Washington, please. [2:05:04, 2:05:20]: The charter doesn't call for an abstention to be counted as anything other than abstention, so a two-two is a tie. So the decision will go to you, Mr. Mayor, if you want to vote. Say again please, the decision will go to you if you wanted to vote as a two-two tie. An abstention is not counted as a vote. It's a it's a no. [2:05:20, 2:05:28]: An abstention does not count as a yes or a no. Then sh where is that in the charter? If there are two yes and two no's. Where is that in the charter? Give me the number. [2:05:30, 2:05:32]: I can't take a statement. Show me that in the charter. [2:05:34, 2:05:36]: Well, that's a conflict. [2:05:36, 2:05:37]: Excuse me. [2:05:37, 2:05:46]: If that is the case then we voted some other times where we had this issue and it was told the ruling was something told we're going to be able to do that. [2:05:46, 2:05:48]: Yeah, that was the full. [2:05:50, 2:05:50]: [7551.7, 7570.0]: Vulner was different. Remember we've had this discussion. The motion on the floor made by Councilman Alexander, seconded by Mayor Pro Tem Thomas, was to approve the comp plan as stated by staff, as approved by for recommendation by staff and the planning committee. [2:06:12, 2:06:13]: And I asked for the vote. [2:06:14, 2:06:17]: And I asked for the vote and I uh what I saw was two, two, one. [2:06:18, 2:06:32]: This is why I kept trying to tell you immediately that my vote is an abstention and you c Mayor, plea Mr Alexander, please. Alexander calm down please say to you that my vote is an abstention. [2:06:32, 2:06:34]: And you continue to go forward. [2:06:35, 2:06:49]: Well actually we looked directly you didn't you didn't say the extension. You declared my vote as a no because that's how I saw your hand up, sir. You s you you're handed. This is why I wanted to when you said my vote as a no, I made it clear to you. All right, stand by. Mr. Washington, are you still looking for that information? Okay. [2:06:50, 2:06:52]: Confused. [2:06:52, 2:06:58]: He's not gonna find it. Mist Mr. Mayor. Yes, sir. I'm gonna take a break while he's doing it. Go right ahead, sir, please. [2:07:02, 2:07:03]: That can be. [2:07:05, 2:07:07]: Yeah, okay, I'll tell you what we do. [2:07:07, 2:07:15]: Uh we'll take we'll take a f we'll take a five minute break if you all don't mind. We'll we'll convene about five minutes. Take your take your break here. As we look for this information. [2:07:41, 2:07:41]: Yeah. [2:07:42, 2:07:42]: Right. [2:08:09, 2:08:10]: Yeah. [2:08:13, 2:08:19]: It was we're out unbounded for seven things. [2:08:22, 2:08:23]: What's it? [2:08:32, 2:08:33]: [7722.9, 7723.7]: Well so. [2:09:05, 2:09:10]: I have no idea. [2:09:10, 2:09:11]: So we're just happy. [2:09:11, 2:09:15]: No no no. When he when you ask a no [2:09:16, 2:09:29]: I don't know what she voted. I raised my hand to say I'm abstaining and you immediately said I voted no. That's why I immediately tried to tell you when you said that that my hand was raised, I'm saying I abstained. [2:09:29, 2:09:33]: I have no idea who voted down there. What happened? [2:09:33, 2:09:34]: So why? [2:09:35, 2:09:46]: I have to play the out of the four between the um thing but uh one did start as well. [2:09:48, 2:09:50]: Yeah, that's how you do it. [2:09:53, 2:09:55]: I have no idea who voted what. [2:10:12, 2:10:13]: That's right. Mm-hmm. [2:10:16, 2:10:18]: He's not gonna find it in the chart. [2:10:19, 2:10:22]: We've been doing this forever and everybody trying to find it in each charter. [2:10:36, 2:10:37]: Quitting acting off emotions. [2:10:46, 2:10:48]: Yeah, solutions for that. [2:10:51, 2:10:53]: Yeah, it's funny. [2:10:54, 2:10:59]: Certainly now it's like [2:11:41, 2:11:42]: All those. [2:11:43, 2:11:45]: I think the first thing you're seeing for. [2:12:26, 2:12:28]: Oh that's right. [2:12:45, 2:12:46]: Yeah, it's all [2:12:56, 2:12:59]: Hold on. [2:13:00, 2:13:10]: I don't think we can see. [2:13:24, 2:13:28]: We have a lot of time. [2:13:35, 2:13:36]: Okay. [2:14:05, 2:14:06]: [8073.1, 8075.3]: [2:14:39, 2:14:40]: It's a new thing. [2:16:20, 2:16:21]: Well, it's right. [2:16:57, 2:17:00]: Mr. Washington, do you have a decision yet? [2:17:00, 2:17:03]: Okay now, all right. On that note, I reopen up the meeting. [2:17:05, 2:17:09]: No no, no, Miss Scant's not back yet, but um assuming she'll be here shortly. [2:17:10, 2:17:11]: Well. [2:17:12, 2:17:13]: We start the meeting. [2:17:15, 2:17:35]: From section three point one five on voting, it specifically says except as otherwise provided in this charter, the affirmative vote of three council members should be required for the adoption of any ordinance, resolution, or motion. And from my understanding, from the clerk who is the official record keeper, she has a two two one. And if it's a two two one, that does constitute a tie. And at that point, that [2:17:35, 2:17:36]: That would be [2:17:36, 2:17:41]: Allow the mayor to vote to break the tie. Let me let me make something clear to you, Mr. Quentin. [2:17:42, 2:17:44]: Mm. When I ask you the question [2:17:44, 2:17:53]: What you were going to look for is my vote to abstain. Right. And you had nothing. I went to look in the charter. You asked me to look in the charter. Let me finish. Please go ahead. [2:17:53, 2:17:57]: You was going to look for something to validate my vote to abstain. [2:17:58, 2:17:59]: Because what you said. [2:18:00, 2:18:01]: [8281.8, 8291.1]: You couldn't validate that. There's no charter to say I can't when m when when the mayor looked at me and said there's a no vote, I said, No, I'm voting to a stain, I immediately told him that. [2:18:12, 2:18:13]: Immediately Excuse me. [2:18:14, 2:18:22]: The clerk can't see me from over there. The mayor does not dictate my vote. John Blount got elected to dictate his own vote. [2:18:22, 2:18:30]: I agree with you. And when I and when you went to check it out, this is why it took so long. Right. I wouldn't ask them in U. I would have asked them in A V. [2:18:30, 2:18:46]: They said they could not pull it back. I asked them on Facebook Live could they pull it back because it's not finished recording. Then I went to the hook. And when I went to the official record keeper, if the official record keeper is a two two one, it's a two two one. Mr. Quentin, let me make this statement to you, to the mayor, and to the clerk. [2:18:47, 2:18:53]: Nobody here is gonna dictate my vote. I'm not. And my vote is to abstain. And that was it. [2:18:53, 2:19:13]: Madam Clerk, whatever Madame Clerk has as your vote is what your vote is. I'm not even giving you what you're doing. So please let's direct this in a conducive conversation, which is what happens when two two one is cast. I went and looked at the charter. It says it takes one. Mayor, point of order. It's argumentative. I'm being told that it's a two two one based on what the record keeper says. [2:19:13, 2:19:27]: Stand by sir. Stand by. Okay, now I'm not going to be able to do it All I can do off Mayor Ford is go off for what the official record keeper has. [2:19:28, 2:19:37]: The the reason why the clerk has what she has is because what I saw. Pi point blank. I asked for a confirmation. [2:19:37, 2:19:38]: I got a confirmation. [2:19:39, 2:19:40]: Two individuals [2:19:40, 2:19:41]: Confirmed. [2:19:42, 2:19:43]: Mr. Alexander. [2:19:43, 2:19:45]: And Mareport Tim. [2:19:45, 2:19:50]: I asked for anybody d for dissension. So I won't tape. [2:19:50, 2:19:57]: And I got that from Miss McGantt and I got that from Mr. Blount. I saw his hand raised. Ask for abstention. [2:19:57, 2:19:59]: A stenchet came from Miss Barber. [2:19:59, 2:20:02]: And then that's one says two, two, one. [2:20:02, 2:20:07]: That's what I said. It's on tape. Now I'll tell you what, I don't even know if can't I don't know if we can go back and review. [2:20:07, 2:20:27]: That's what I asked. That's what I was looking for. They were trying to look that up back there in the room for me on Facebook Live and on the video feed that they have. And they and they they can't you can't go back until it's finished recording. Right. So at that point, then I have to go to the third source, which is the official record keeper as to what she has. Whatever you all, I'm not calling what the vote was, I'm calling what you [2:20:27, 2:20:33]: you all gave me to tell you it's a tie. If you tell me it's an abstention, if you tell me it's nobody voted. [2:20:35, 2:20:38]: If the record keeper says nobody voted, then that's what happened. Right. [2:20:38, 2:20:58]: So that's what I'm waiting for instruction from you all for. If it's a two two one. I I say what my eyes saw, and I've been the my my eyes saw was a two two one. That's what I saw. That's what I told you. Right. And so if the vote wants to be changed, then we've done this before. He thinks he said he did something differently. It's not what I saw. Right. And if the vote wants to be changed the way we've done this before, if the people on the prevailing side [2:20:58, 2:21:06]: Can do a motion for reconsideration of their vote. Once you vote, it'll be the determination of it. [2:21:06, 2:21:18]: It's a tie. Okay, once you vote, the people on the prevailing side can then determine whether or not they're gonna do a motion to reconsider to allow him to change his vote and we've done that before. Nope. Uh well here's my point of order. [2:21:19, 2:21:29]: I'd like to make a motion for this council to accept my vote, my actual vote. So my vo I would ask this council to let me place [2:21:29, 2:21:30]: My actual vote. [2:21:31, 2:21:34]: And that's that's you all calling it. [2:21:37, 2:21:38]: We can legally do this? [2:21:38, 2:21:44]: You have there's a two two one. Right. Until that two two one is decided whether it passes or fails. Right. [2:21:44, 2:21:50]: You can't do a most consideration until you hit it. Two two one. I what I I said what I said, what I thought. [2:21:51, 2:21:55]: On that note, to make this move this forward, I vote in affirmative, we make sure three. [2:21:55, 2:22:15]: Two one. All right. That's my vote. Right. Based on what I saw. Now, if we want to go back and re- reconsider something, hold on for a second, sir. You want to go because I'm getting fed up with this. We want to go back and reconsider. And he wants to reconsider his vote, but he's not he's on he's on not on the prevailing side. Okay. So he's talking about want to make some type of uh a readjustment to this. [2:22:15, 2:22:21]: Can we legally do that? The three people on top would one of them would have to move to reconsider the vote. [2:22:21, 2:22:34]: Yeah, that's it. Three two one, that is it. As far as I'm concerned, the three people on the three people that the clerk would call up that on top, one of them would have to make a motion to reconsider. We've done this before. All right. Is there a motion to reconsider in a three and a three? It's been made and it's been second, Mayor. [2:22:35, 2:22:48]: No no no no no on no no no no no. Made and seconded by who? Cancer Woman. The three point of order. You're not on the you're you're not on the part of the three side. Correct. You're not on the three sides, you can't. Right. [2:22:48, 2:22:49]: You can. [2:22:50, 2:22:50]: Now [2:22:52, 2:22:55]: Clerk, you have that, right. Correct? [2:22:55, 2:23:00]: All right. We are moving on, ladies and gentlemen. We're moving on. As long as we're legally right, we're moving on. [2:23:01, 2:23:07]: Now, on that note, going to number six. Uh point of b point of order, Mayor. Well I'm I'm moving on, sir. Point of [2:23:07, 2:23:16]: I could care less, Mayor. What I'm saying to you Appeal to the council point of order. No, it is not. You're not on the prevailing side, sir. [2:23:18, 2:23:20]: Ms Mr. Quinn, can you make that clear for us, please, sir? [2:23:22, 2:23:24]: Which which which is the prevailing side? [2:23:26, 2:23:28]: Indeed. [2:23:29, 2:23:38]: Or the two that voted with May? Two the voted with the mayor on the affirmative side of the motion. So from what I understand that would be the mayor, Councilman Alexander and Mayor Pro Tem Thomas. [2:23:39, 2:23:54]: So I don't get a motion. No, you do not. And I'll tell you what. By chance, once we're b when the meeting's complete, we'll have a video. When the meeting's complete, we'll have a video. And I'll tell you what, I'm let me say this publicly. If the video shows anything different [2:23:55, 2:24:15]: Then what I d what I saw, when you look at the video, legally, well maybe we can make that change. But the point of it is I don't think it's gonna show anything any different. We can't go back on the video at this point. So we're gonna move on. Number six. More to follow. Stop it. Rezoning case, RZ two zero two two dash zero one. Remember development L L C. [2:24:14, 2:24:34]: The applicant represented by ballot law PC. The agent requests the rezoning of a certain property from the C1 neighborhood commercial to C2 general commercial. Districts to the PUD. Plan unit development. Overlay district to allow for mixed use. Development. The property contains two parcels as listed below. The 68 [2:24:34, 2:24:54]: The smaller parcel. Currently zone C1 and PMU contains 3.131 acres, comprises the property of 10 36 Highway 138 West across on Spivey Road. [2:24:54, 2:24:57]: [8697.5, 8717.5]: Parcel number 012-01002000. The larger parcel currently zoned is E2. And PMU contains 65.743 acres. Situated adjacent to the western side, a smaller parcel with front is on Highway 138 west across from Tributary Parkway, located land lot 42 of District 12. [2:25:17, 2:25:37]: Note. The Planning Commission recommended disapproval of this case with conditions of the meeting on May 26th, 2022. City Council recommended deferred to other vote on this item out at is July 11th, 2002, 2022. Excuse me, 2002. Well, 2022. And uh the meeting was gonna be held [2:25:37, 2:25:48]: on August 8th of 2022, which is tonight. So we already actually have a um an open pub public uh hearing on this really what this is number six is really in a sense for a vote. [2:25:48, 2:25:55]: Period. We've already had public hearing. On that on that note, Council, I need a motion to accept this uh rezoning case. [2:25:55, 2:25:56]: An affirmative. [2:25:56, 2:25:58]: So move is there a second. [2:25:59, 2:26:02]: That's okay. [2:26:02, 2:26:09]: Yes, sir. Go right in, please. Um, I wanted to add the condition for the stub out. [2:26:10, 2:26:13]: Um is now the time for me to do that. [2:26:14, 2:26:18]: I I would say it pr seems like legally you can do that at this point. [2:26:19, 2:26:32]: Well I made the motion. You want me to add it or you Yeah, make the I wanna uh add the uh condition as described by Councilwoman Barber for the two stub outs, correct? One one stubb out. I only do one uh one stub out. [2:26:35, 2:26:36]: This wasn't cut. [2:26:41, 2:26:46]: battle as the interparal connectivity about [2:26:48, 2:26:50]: She mentioned yes, but I don't [2:26:52, 2:26:55]: Yes, that is what Miss Battle mentioned. [2:26:55, 2:26:58]: Байн тін да із апроч. [2:26:58, 2:27:01]: For us, it would cause a city. [2:27:01, 2:27:02]: To have to [2:27:02, 2:27:03]: Go to each of those [2:27:04, 2:27:05]: Partial [2:27:05, 2:27:06]: And property owners. [2:27:07, 2:27:08]: Asking them to do it. [2:27:09, 2:27:10]: As opposed to [2:27:12, 2:27:15]: this development just adding a stub out. [2:27:19, 2:27:28]: Well hold on, who's talking? Ma'am, ma no, ma'am, you you you you you've had your time for public hearing. I'm sorry. Uh Miss Battle, maybe you need to come back to the podium here. [2:27:30, 2:27:30]: Yeah. [2:27:37, 2:27:38]: Whatever. [2:27:41, 2:28:01]: about interparcel connectivity is that as you all are you can modify your um overlay district to require interparcel activity. That's something that you all can do afterwards. And then that way you don't have to go to each individual property owner. It's in the ordinance that if anybody is looking [2:28:01, 2:28:02]: Yeah. [2:28:03, 2:28:23]: Those properties, they have to provide interpersal connectivity. So anybody that's developing, for example, we are subdividing out a portion of our property, of the property that's being developed here. That property owner would have to provide interpersal connection for us. So that is the way I've seen other municipalities. [2:28:23, 2:28:35]: Do it, but you do it within the context of your overlay. So that's just an amendment, uh text amendment you all could do to ensure that. But you know, again, that's something that you may want to do, period, um, regardless of this. [2:28:36, 2:28:47]: particular matter. Um so that was what I was um referencing. But meanwhile, we'll put the inner parcel uh we'll put the stub out wherever um w we can agree on a a location with the staff. [2:28:47, 2:28:53]: And you all have got to come back to get approval for the design phase. [2:28:54, 2:29:02]: We'll be going through yes, with the um staff we have to put in our um LDP application and to show that we're in compliance with the overlay district. [2:29:03, 2:29:19]: Okay, so how do I know um which area is decided upon for the stub out? We would have to work with the staff on the location of the stub out. Um we don't have it shown on here. The one stub out could have been up at the front, but if you want it somewhere along the side. [2:29:19, 2:29:21]: We'll have to work with our engineer. [2:29:21, 2:29:24]: Um to come up with the staff and show the location. [2:29:25, 2:29:26]: And I'm sure staff will share that with you all. [2:29:27, 2:29:36]: Okay. Um also I wanted to thank you. Thank you for that. Also wanted to ask Ms Ms Bell, take take place just in case please. [2:29:37, 2:29:38]: Go ahead. Go ahead, Ms. Robert. [2:29:39, 2:29:46]: Can we ask for a decrease in the amount of apartment units? Again, is now the appropriate time to ask. [2:29:48, 2:30:01]: Well, I I don't know about all that. I mean how l how unless legally we can do all that now. All right. We we we have set at the two ninety seven. Um we reduced that number um previously, so [2:30:01, 2:30:05]: Okay. Thank you. Okay, stand by. Okay, Miss Ms. Holliday. [2:30:06, 2:30:11]: There were seven conditions attached to this that um staff is going to read into the record. [2:30:11, 2:30:12]: Okay. [2:30:13, 2:30:17]: All right. I would ask that it would also include the conditions [2:30:17, 2:30:18]: Okay. [2:30:23, 2:30:26]: It's part of our discussion phase here. Go right ahead, please, Mr. Anderson. [2:30:26, 2:30:30]: Uh the planning and zoning staff recommend approval with conditions. [2:30:30, 2:30:48]: For the proposed rezoning of the subject property from C one, C two and PMU and PMU to PUD. Uh the recommended zoning conditions are listed. The project will be developed in conformance with the City of Stockbridge Unified Development Code and all other city code sections regarding site development standards and requirement. The approval number two. [2:30:50, 2:31:07]: The approval of which is already up the approval of KCP twenty twenty two-01 to change the property's future land use designation from low density vertical to high density residential. Number three, regarding the parcels comprising the development site. Uh the pro the [2:31:09, 2:31:27]: The smaller parcel has to to be sub subdivided and and combined with the with the rest of the property. Um the applicant sh number four, the applicant shall comply with the following, take steps for the environment protection of Reeds Creek. [2:31:30, 2:31:50]: No l and number five, no land disturbance or building permits shall be issued for the subject property until the applicant has had the new recombination plat officially recorded and has submitted a copy of the recorded plat to the community development department. Number seven, number six, I mean, the proposed project will be developed in general conformance with the site plan rezoning exhibit. [2:31:50, 2:32:00]: for Highway one hundred thirty eight, dated april fourth, twenty twenty two, with no more than two hundred ninety seven apartment units and a minimum of one hundred and twenty eight fee simple town homes. [2:32:01, 2:32:21]: Number two, there should be a mandatory homeowners association for the townhome community with a recorded declaration of restrictive covenants, which limits the total number of rental units within the townhome community to no more than five percent. Number three, the frontage along Georgia Highway 138 adjacent to the apartment units shall be landscaped with trees and shrubs. [2:32:21, 2:32:23]: As approved by the city arbore's [2:32:24, 2:32:31]: In order to provide a visual buffer from Georgia Highway one hundred thirty eight, the land straight strip shall be a minimum of twenty feet in width. [2:32:33, 2:32:36]: Number nine, department communities shall be gated. [2:32:37, 2:32:44]: Number ten, there should be a separate amenity area for the apartment community and the townhome community with a pool and clubhouse for each community. [2:32:45, 2:32:50]: Number six, the townhomes shall be all brick fronts. Those are the eleven conditions. [2:32:51, 2:33:10]: Okay now and then s this other con that's eleven conditions already and that's already included what she wanted to add in. No, that'll make twelve. That would make twelve, but that needs to be added in. These eleven conditions are already in no right now at this point. So what Ms. Barber wanted had to be added in to the motion and the motion be made and seconded and then also would have to be approved. [2:33:11, 2:33:13]: Yes, sir. All right. So [2:33:13, 2:33:14]: Yeah. [2:33:15, 2:33:23]: I make a motion based on the staff recommendation uh plus the uh additional condition that Mr. V Ms. Barber mentioned. [2:33:24, 2:33:26]: [9207.6, 9210.3]: Okay. That's my motion. Okay, is there a second then motion? [2:33:31, 2:33:35]: I second. Okay, Mayor Protestant second that. Ms. Gantt do you have some additional comments? I did. [2:33:36, 2:33:38]: Who came up with the all-brick front? [2:33:38, 2:33:40]: Councilman Alexander, was that you? [2:33:40, 2:33:45]: No. Okay. Anybody? Who came up with the all bri brick front? [2:33:46, 2:33:47]: And why? [2:33:48, 2:33:50]: And the reason why I ask is because [2:33:51, 2:34:00]: You voted against the colour. Some of the designs now going on right now w with certain properties, whether it's um high end [2:34:01, 2:34:08]: Or not. We usually have a blended and we had a I believe we had some type of um [2:34:09, 2:34:20]: I'll support it, however. Some type some type of um plan where we would have a percentage of w what it could be stone, a percentage of what it could be of of [2:34:20, 2:34:40]: I think I think at one point there was discussion about it being an all brick front. We are actually much happier with the fifty percent or seventy-five and other textures along, which is what we originally presented. Um but it was requested. Um I thought we we thought it had been requested. Who requested it? We did as it wasn't our discussion. [2:34:40, 2:34:41]: Whoa, whoa. [2:34:42, 2:34:44]: Mayor Pro Tem Thomas, did you request it? [2:34:45, 2:34:59]: Um Mayor I mean um Councilman Blank, did you request it? Mayor, did you request it? Councilman Barber, I'm coming. We discussed it. Did you request the front of all the buildings to be bricked? [2:34:59, 2:35:08]: I would like to see Brick on all four sides of the town hall then a big thing. The reason why I ask is because [2:35:08, 2:35:14]: This mayor and council did not request that. Wait a minute. Wait a minute. [2:35:15, 2:35:35]: We can be councilman Alexander. We can be council with our respect, Councilwoman Barber. It could you could want Albrecht, but there's a concern I have. And the concern I have is that individual council members speak as we and we all have a say. We all were voted individually to represent our community on our [2:35:35, 2:35:38]: Stand by, stand by please. [2:35:38, 2:35:40]: I'm not finished. Thank you. [2:35:41, 2:36:01]: I was represented just I was voted in just like each and every one of us and we are all entitled to our own opinions. But aesthetically, there are i you know, we always wanna compare to the northern inner town or whatever the case may be. Well if you do an all brick apartment complex and it looks like a project. So if you w w and [2:36:01, 2:36:21]: Particularly, I want us to really think about the way things really look when it comes to craftsmanship and houses. And none of us are experts on it. So maybe we need to go back and get that. And you can say it holds value all day, but so does a nice stuck with stone and brick and different types of design. [2:36:21, 2:36:27]: If I want to if they bring them to us, I don't want to make that a condition until [2:36:27, 2:36:28]: Until [2:36:29, 2:36:49]: I can see that design on what it's actually gonna be on that facade. That's what I want. Okay. We didn't say nothing. Okay. Stand by. Let me get that quite I'm tired of that. All right. All right, Miss Camp, please. All right, stand by please, sir. So we no we actually hold on. Hold on, please. Hold on, please. Ryan, you you you brought these conditions [2:36:49, 2:37:09]: Get get on the mic, please, so we can hear you clearly. And I have the picture up. That's what we originally proposed. [2:37:09, 2:37:29]: heard it from city council. However, the Parkway mixed use overlay district uh allows stucco require stucco, brick, veneer, or other types of um and brick. So it's just it just wouldn't be limited to brick. There are several different types of materials. One second. Point of order from our UDC in the parkway mixed use [2:37:29, 2:37:37]: Overlay district requirements. So it wouldn't be just brick, they will have several options, including the one that council member some of the options that Council Member Gantt recommended. [2:37:37, 2:37:57]: All right. Stand by a second. Ms. Battle. We have to stand by please. Ms. Battle. Okay. Those were the original designs on the units. Um and we certainly had agreed and understand that under the uh UDC that we are actually required to have a minimum of [2:37:57, 2:38:17]: 50% brick stone. And so we're fine with that requirement. We went to the all brick front based on conversations with some of the other council members. However, obviously to the extent that the board itself does not want that, I mean that's certainly [2:38:17, 2:38:37]: Certainly, your ability to say, hey, we would prefer it to be, you know, as it is in the ordinance. Um, again, we were simply trying to address the issue that had been raised, but again, um 50%. We are we want to comply, what our intention was was to comply with the UDC with regard. [2:38:37, 2:38:45]: Regards to what the um material requirements are. And we're happy to have you. Hold on, hold on, folks. Stand by. Thank you, Miss Bettle. Hold on. [2:38:45, 2:38:46]: More potential. [2:38:47, 2:38:50]: May I let me try to try to correct the issue here. [2:38:51, 2:38:54]: If if counsel wilt remember Miss Battle [2:38:55, 2:38:57]: And uh Mr Ryan, I know y'all do. [2:38:58, 2:39:00]: Y'all attempted [2:39:01, 2:39:20]: To meet with all council members uh by Zoom. I know I met with you. Uh I'm not sure who else met. I did this one. But all of these things were discussed. Right. And and and here's Ryan now, but all of these things were discussed. [2:39:21, 2:39:31]: And in those discussions this was talked about. And I know I was okay with that as it came up in the discussion. [2:39:31, 2:39:41]: So and I don't know Miss Battle or um Rain, that's that's his name correct. Yeah. Uh he making uh speak to this as well. But you all attempted [2:39:42, 2:39:51]: And you can only answer who met and who did not meet, but you attempted to meet with all council members, and all of these things were discussed. [2:39:52, 2:40:02]: And all of these things had um an a an agreement or an approval. So when you left these discussions, this is what it was. [2:40:03, 2:40:23]: Now that is my recollection to how And to be and to be clear, um we reach out to each council member to see if we can have a chance to address any questions or concerns that have been raised. Not a single solitary one of you, all I want to make this clear, said that you were voting on anything other than to tell us [2:40:23, 2:40:43]: you know, the things that were important to them as um elected officials. And so it's not unusual in a lot of cities and municipalities, particularly regarding facade designs, um, that we get even requests for four-sided brick, three-sided brick, one-sided brick, you know, that seems [2:40:43, 2:40:58]: to be um the litmus test for quality. I don't particularly agree with that. I think that theirs can be quality without it all being all brick. But we also try to address the issues and the desires that are raised by the community. [2:40:59, 2:41:06]: All right, thank you. Ms. Alexander, last time. [2:41:07, 2:41:24]: I say that we just poll the council. We can solve it right now. I I I would support all brick front. Let's just poll us. We right here. You don't have to guess what we want. Just tell'em. We could poll it. I support it. Mayor. Yes, we'll send by a second. Does anybody else need gonna need to answer that question? [2:41:25, 2:41:27]: In my discussion. [2:41:29, 2:41:41]: When I had my individual discussion with the developers, I was okay with that and I I am still okay with that. All right. Ms. Blount? Man, I'm not going to do business like that. Okay, Ms. Cat? [2:41:41, 2:41:57]: Thank you. I are you asking me do I'm I'm I'm I'm asking for for this particular question right here, just so we can get Okay, so I my concern is is that what will all brick look like? Sometimes it does it lacks character to have all brick. [2:41:57, 2:42:10]: I would love to see some other options is what I would like. I would like to not have to necessarily approve the design of the building right now. And w so whatever language we can put in right now. [2:42:10, 2:42:28]: to add as a condition upon approval of the designer, you tell me which way this goes, um, that's what I would want. And the reason is sometimes a house has characters, a craftsman's house is not really necessarily all brick. Okay, let me stop. Let me ask you a personal question. Let me I'm pulling Miss Miss Barber? [2:42:31, 2:42:31]: I just [2:42:32, 2:42:34]: When I brought up the whole issue with [2:42:35, 2:42:38]: Forest out of brick, it was because I took a drive to Winding Creek. [2:42:39, 2:42:53]: townhomes and they're four sided brick. So I figured why not this four sided brick. But I remembered um my last conversation with Miss Battle and Mr. Hurrows. They explained [2:42:54, 2:42:57]: Аддимо брик із гонти інкріз та кост. [2:42:57, 2:43:01]: Um and if we are trying to really develop a [2:43:02, 2:43:04]: development that is [2:43:07, 2:43:14]: affordable um for everyone, then to keep down the cost, the one sided break is what they offered. [2:43:14, 2:43:16]: And that's what the look is. [2:43:16, 2:43:36]: All right, all right, now all right, so now we got we got that uh as a rough draft, rough little uh type of idea from the council. Now, there was a motion that's on the floor, and the motion was seconded, is my understanding. Is that correct? Yes. Okay, Miss uh and Miss Holliday, please read back the motion as you as [2:43:36, 2:43:41]: As as you have it and make and make sure we have it we have that right and then we'll take a vote. [2:43:42, 2:44:02]: The mayor um the motion made by Councilman Alexander, seconded by Mayor Pro Tem Thomas, is to approve the rezoning case RZ 2022-01 with the eleven conditions as described by staff and the additional condition as described by Councilwoman Barber with the interparcel connectivity. [2:44:02, 2:44:03]: Uh stub out. [2:44:04, 2:44:13]: Okay. And that that and Alexander s Mr. Alexander, since you made the motion, that is correct. Is that correct? That's correct. Okay. The motion was made, it was second. All in favor of the motion, please indicate. [2:44:14, 2:44:16]: All posed. [2:44:17, 2:44:18]: I'm sorry. [2:44:19, 2:44:23]: Can you repeat that motion again, please? One last time. [2:44:23, 2:44:24]: Okay, the motion. [2:44:25, 2:44:35]: made by m Councilman Alexander, seconded by Mayor Pro Tem Thomas, is to approve the rezoning case number RZ two zero two two two two two two two two two two two two zero one. [2:44:35, 2:44:40]: With the eleven conditions as described by staff and the additional condition [2:44:40, 2:44:44]: As described by Councilwoman Barber for interparcel [2:44:44, 2:44:46]: Connectivity stub out. [2:44:48, 2:44:49]: That's the motion on the table. [2:44:50, 2:44:59]: All right. Second there, Mayor Pro Toon. No, you the motion was already second. She's just giving clarification here from Miss Barber. Motion is made in a second. All in favor motion, please indicate. [2:45:00, 2:45:01]: I have three, all opposed. [2:45:02, 2:45:22]: Abstain. Abstain. I abstain. Right. And Mayor Three Zero Two. Motion passed. Mayor, the reason why I abstain is because I don't approve of of the design of going ahead and saying, okay, let's do all brick until we were able to see different options. All right. Thank you. And for the record. [2:45:22, 2:45:26]: I met with them but only once. Didn't be with them anymore. [2:45:27, 2:45:33]: All right. The next three items on the agenda, item number seven, eight and nine. [2:45:34, 2:45:54]: Uh deal with um all EC's items the requester is indicated that the request for defer for a public hearing until August twenty fifth of twenty twenty two, Planning Commission meeting is in September. Uh let me back up again. Request the deferral of the public hearing until twenty uh twenty fifth of August of twenty twenty. And uh new business here, council's consideration to appoint a member of the Citywide Development Authority Board. [2:51:53, 2:52:13]: Presented by Mr. Washington. Um my comment to that is that typically we we talk about this in in our second session and then then the Brent come out after second session to uh make the announcement made on this aspect. Are we looking to do that tonight or are we just gonna outrightly have this open discussion now? Yes, sir. My understanding is it's two for two slots. [2:52:13, 2:52:16]: We have seven slots, right? We got three available. [2:52:17, 2:52:19]: Well the clerk said one application was incomplete. [2:52:23, 2:52:23]: Okay. [2:52:25, 2:52:32]: So if you wanna w if you all want to ex t accept the two, then you can do it now if you all wanna go into executive session and then discuss and come back out, but they're [2:52:33, 2:52:36]: You have more people, you have more slots than you do have people. [2:52:37, 2:52:37]: All right. [2:52:38, 2:52:44]: Counseling, what are your desires? You wanna do this now here or you wanna do it in the second session? Sir. Yes, yes. [2:52:44, 2:53:00]: Uh I mean honestly, I know uh we all know uh these applicants. I know we know our Ariel Shaw, Southern Crescent Women in Business, and uh Kathy Hills is a distinguished uh representative of the community who resides in the city limits. Uh [2:53:01, 2:53:01]: Uh-huh. [2:53:03, 2:53:23]: Right, right. I I'm just saying I I I know them and uh they've been to many of our events. Uh the her family is very well distinguished in the community. Uh the gentleman is an attired executive from Georgia Power, and certainly uh his wife is a retired executive as well uh for the Citywide Development Authority for the council to consider. [2:53:22, 2:53:23]: Yeah. [2:53:23, 2:53:28]: I understand that, but uh um just wanna w how we wanna hound this. Yes, Ms. Gantt. [2:53:29, 2:53:45]: I just I think that we should always do what we always done unless we've agreed. And I don't think we should have had this discussion out in public period. Right. So I have a problem with procedure in general. I think we should always do it the way we've always done it, unless we as counsel [2:53:45, 2:53:49]: decide to change it but I don't think we should have that an open I mean I think we should [2:53:50, 2:53:51]: Discussion. [2:53:51, 2:53:56]: Okay. I don't know everybody either. I know one person, so I think we should have that discussion. [2:53:57, 2:54:17]: All right. Is that a consensus of the council here that we need to have this executive session? Okay. And uh so otherwise also that would be council consideration to fill a vacancy to appoint a member of Downtown Development Authority, Mr. Quinton. So um Mr. Washington, so we'll uh do this in executive session, come back out and uh say we didn't have any complete completed application for the [2:54:17, 2:54:21]: S D D A. We did not. Correct. Okay. Is that correct? [2:54:24, 2:54:24]: I'm sorry. [2:54:25, 2:54:35]: Okay, we'll do that. We'll do that in a second session then. Alright, so obviously we know we have that coming up. Okay, on that note then um I have uh some comments here. [2:54:35, 2:54:55]: And uh besides the the normal comment in reference to the pandemic and COVID nineteen and getting your test and boosters, which is something that we all should be doing anyway, and and I've been talking about this for well over two years. But something new this is popped up is called this monkey pox, all right. So it's a rare disease caused by [2:54:55, 2:55:10]: infection with the monkey monkey monkey pox virus. So um and it can currently can be transferred um with close contact, skin to skin contact, actually. And so there is mus monkey pox testing and vaccinations are available through [2:55:11, 2:55:31]: The Georgia uh Public Health Department in in uh Henry County. We're actually in District 4 of the Public Health Department. And you can call them at 706-845-4035. Once again, 706-845-4035 and get some additional information and guidance on how to get [2:55:31, 2:55:51]: vaccinated and information about the monkeypox and and things of this nature as well. And you can also go to Henry County, talk to the Henry County Health Department located at 135 Henry Parkway. And that is that number is 470-664-0005. Get more information. And the last information I knew about this is that there are at least [2:55:50, 2:56:10]: 500 people within 500 plus people in the city excuse me in the state of Georgia that actually have contracted this thus far. And it typically once you have it and you get vaccinated, you have to be isolated for anywhere from two to three weeks to get over this thing. So they suggest that if you have it, of course, you stay home. [2:56:10, 2:56:30]: And uh please have to go out to medical care and uh separate yourself from the other members in your family, your household. Wear a well-fitted mask and cover up your skin lesions, wash your hands often, separate yourself even from your animals in your home, and disaffecting clean high-tech areas by which [2:56:30, 2:56:50]: Wash you know also wash the clothes, beddings, towels, clothing on a continual basis and keep things clean. Additional information you can you can get from the DPH the website uh the email address, the website here. I'm sorry, dph.georg.gov slash monkeypox. Once again, dph dot georgia.gov. [2:56:50, 2:57:10]: Dot G O V slash monkeypox to give you more information about that. So it needs to be aware of what's going on in this public health issue. The other things I'd like to mention to you, of course, we had a very busy weekend this past weekend. Of course, Saturday we had the headliner uh concert with Rick Springfield, but because of the [2:57:10, 2:57:30]: weather situations uh we had to cut things short. So I want people to know that uh our our contractor for the amphitheater, GRA, is working with the the management company and the managers uh over the artists and primarily Rick Springfield to look at what we can do to get him back in here uh to uh actually perform [2:57:30, 2:57:50]: at our amphitheater and they're looking at a time frame very shortly to hopefully very shortly shortly as we uh look at uh date and uh to get them back back here to perform so the suggestion is that uh for everybody that was present they hold on to your your tickets wait for the information to come out [2:57:50, 2:58:10]: out in reference to a new date and then uh additional guidance will come out in reference to how you can come back andor what we need to do to to satisfy the requirements best as possible for those folks that it got that unfortunately missed out due to weather concerns and safety concerns of lightning and and thunderstorms in the area. And the uh the actual highlighted ban for that was the SOS band, which came on, of course, at the very end of the night. We had a we had a little bit of about a half an hour, maybe 35-40 minute delay due to the weather and being cautious in this aspect as well. Um, but uh Mary Davis to read.
