That would be a density of five units per acre approximately. [0:17:47, 0:17:48]: Um [0:17:49, 0:17:53]: And I'll just tell you about the second track to the north, um, if it would be combined. [0:17:53, 0:17:54]: Um [0:17:54, 0:18:10]: There would be another 176 independent living units and at a density of eight units per acre, total density six point six units per acre, which would be in the category of high density residential land use designation. [0:18:14, 0:18:26]: The um applicant site plan um show that there would have three accesses into the subject property. They would keep the one that's there already serving the existing uh facility. [0:18:27, 0:18:38]: And also the um technology parkway street, um it dead ends into the second parcel. Uh the applicant would add a new um [0:18:38, 0:18:40]: Access point. [0:18:40, 0:18:41]: in in the center of [0:18:42, 0:18:44]: Highway forty two north. Um [0:18:45, 0:18:46]: And cross over the stream. [0:18:47, 0:18:48]: This would be across from Glenmore Lane. [0:18:49, 0:19:00]: Amenities, uh each track would have his own amenities. So track one, the subject of the annexation, would add they would add a clubhouse, a pool, and a cabana. [0:19:00, 0:19:04]: At track two to the north, they would add pickleball courts, a pool, and a cabana. [0:19:05, 0:19:09]: Um there'd also be two detention ponds and an an a larger detention pond. [0:19:10, 0:19:12]: Um they [0:19:13, 0:19:17]: Architecturally that have the proposed homes would have pitched roofs, hardy flat. [0:19:18, 0:19:19]: Thank Ben Veneers. [0:19:19, 0:19:21]: And single car garages. [0:19:23, 0:19:24]: Here is a [0:19:24, 0:19:30]: drawing a boundary survey of the existing parcel and this shows this is highway forty two north here. [0:19:30, 0:19:33]: And right here is the existing uh facility. [0:19:33, 0:19:35]: uh re rehabilitation facility. [0:19:37, 0:19:44]: This is a Henry County zoning map. Um here again is a subje subject parcel that is to be annexed. [0:19:44, 0:19:49]: And then the second parcel right here is this uh irregular shape parcel. [0:19:49, 0:19:53]: would be the second one they'd hope to combine with for the total development project. [0:19:54, 0:19:55]: Uh-huh. [0:19:55, 0:19:58]: Henry County land use design map designation map. [0:19:59, 0:20:01]: The subject property here in a the lavender. [0:20:02, 0:20:04]: And um that it's mixed use. [0:20:06, 0:20:10]: Now here is the conceptual site plan. I know it's small, it's been reduced, but [0:20:11, 0:20:13]: Uh basically you have the existing facility here. [0:20:14, 0:20:15]: Some additional uh [0:20:16, 0:20:17]: Units to be built adjacent. [0:20:18, 0:20:21]: And then you have a f floodplain area where the creek is. [0:20:21, 0:20:24]: Uh then this is a new access that would be built here. [0:20:25, 0:20:30]: And a technology parkways here to the north, it dead ends into the other part of this second parcel. [0:20:30, 0:20:33]: Any additional units would be built in that area. [0:20:34, 0:20:39]: Here is a rendering of what the proposed units may look like. You see the pitched roofs. [0:20:39, 0:20:43]: single car garages and uh the facades. [0:20:46, 0:20:49]: We've perform analysis with uh different criteria. [0:20:50, 0:20:52]: I'll just briefly mention some of these. [0:20:52, 0:20:53]: They [0:20:54, 0:20:59]: subject parcel to be annexed is in fact adjacent with the Stockbridge city limits, so that [0:21:00, 0:21:01]: Uh qualifies. [0:21:01, 0:21:06]: А ездистин са ватар север сервис ава. [0:21:06, 0:21:08]: uh electricity provided by Georgia Power. [0:21:09, 0:21:14]: Uh police services they're currently provided by Henry County, but that would change to City of Stockbridge. [0:21:15, 0:21:15]: Um [0:21:17, 0:21:29]: Okay, again it's gonna be two hundred and seventy-six independent living units. Uh the property this parcels outside of the city, uh with a land use designation of mixed use and um [0:21:29, 0:21:30]: The [0:21:30, 0:21:35]: Parcel to the north has low density residential and light industrial designations. [0:21:35, 0:21:35]: Um [0:21:36, 0:21:39]: The applicant has submitted a comprehensive plan amendment. [0:21:39, 0:21:43]: uh to to change those to be compatible with proposed development. [0:21:44, 0:21:44]: Um [0:21:45, 0:21:46]: There is no [0:21:46, 0:21:47]: Common [0:21:47, 0:21:54]: adjacent zoning, but the applicant has sought a rezoning application to PUD planned unit development. [0:21:57, 0:22:01]: There are potential positive effects, uh, they'd maintain the existing center. [0:22:01, 0:22:07]: Uh many of the proposed units would not be visible from the main road, they'd be toward the rear. [0:22:07, 0:22:12]: Uh there may be some challenges in developing the site because of the creek and the floodplain areas. [0:22:12, 0:22:16]: Um there would be a it look like on the site plan a [0:22:17, 0:22:19]: Uh bridge crossing [0:22:19, 0:22:21]: I couldn't tell exactly or might go underneath. [0:22:22, 0:22:30]: Uh there's a letter from Henry County Water Authority uh which stated that although water and sewer lines are present on the site. [0:22:30, 0:22:36]: um the developer uh would have to uh relocate that, the eight inch sewer line. [0:22:36, 0:22:38]: And also install an easement. [0:22:39, 0:22:42]: Proposed tran are likely traffic of transportation impacts. [0:22:43, 0:22:50]: developer would have to coordinate with the Georgia DOT and uh Henry County DOT because this is state road, highway forty two north. [0:22:51, 0:22:54]: Regarding possible intersection improvements at technology parkway. [0:22:55, 0:22:55]: Um [0:22:56, 0:23:01]: And the the new entrance uh seems to be uh acceptable. [0:23:01, 0:23:03]: Although they should add a deceleration lane. [0:23:05, 0:23:10]: Uh there may be some challenges in the environmental impacts, as I mentioned a moment ago. [0:23:11, 0:23:22]: uh recommendation. Uh we say that the proposed annexation is reasonable uh in view of the following applicant plans to incl to include this parcel with adjacent parcel. [0:23:22, 0:23:23]: Proposed development. [0:23:24, 0:23:27]: uh compatible with surrounding land uses and conditions. [0:23:28, 0:23:31]: We feel that the analysis criteria are s basically satisfactory. [0:23:31, 0:23:34]: So we recommend approval of this proposed [0:23:34, 0:23:37]: annexation into Stockbridge city limits. [0:23:40, 0:23:42]: Are there any questions? [0:23:43, 0:23:47]: Ms. Logan, uh what's the minimum age requirement for these for this development? [0:23:47, 0:23:48]: Sorry. [0:23:48, 0:23:51]: Minimum age requirement, did you acquire that from the applicant? [0:23:51, 0:23:53]: I think it's fifty five plus. [0:23:53, 0:23:57]: Fifty five plus. Right. And uh what is the price point? [0:23:58, 0:24:00]: I'm not familiar with that. [0:24:01, 0:24:01]: Okay. [0:24:02, 0:24:06]: The applicant pro could probably answer those questions. Okay. Is the applicant present? [0:24:13, 0:24:14]: Yeah, right. [0:24:16, 0:24:21]: You're the applicant, sir? Yeah. Just asking this general question what would be the price point for the units? [0:24:24, 0:24:29]: Would you come to the to the uh podium? Uh provide us with your name. [0:24:32, 0:24:36]: Mr uh Chairman, is it okay for the apple to go ahead and and do their presentation as well? [0:24:37, 0:24:39]: That was just a question I had for Miss Logan. Go ahead. [0:24:40, 0:24:41]: Beh my carbon. [0:24:42, 0:24:53]: Okay, so here. We're done with this. I think you have your your presentation? I loaded it. You gonna make your presentation now? Yeah. Is that is that it? Yeah. Yes you can go ahead. [0:25:02, 0:25:04]: Um [0:25:17, 0:25:33]: Good evening, Michelle Battle with Battle Law here representing um the applicant um in connection with the proposed um annexation rezoning and comprehensive um plan change. One question I have before I start my presentation, are we taking all the applications at once? [0:25:34, 0:25:36]: We are not. This is only for the annexation. [0:25:36, 0:25:56]: Okay, because I don't want to be redundant. So I don't want to say the same thing three times. So I'm going to try and focus just on the annexation right now. What we know with regards to this property, um, which is again located off of Highway 42, is that um it is currently being utilized by Southern Crown. [0:25:56, 0:26:16]: Crescent TBI Center, which is an inpatient healthcare facility that's dedicated to providing medical and rehabilitation services for individuals who suffer from traumatic or acquire brain injury. This property was rezoned by Henry County not too long ago to [0:26:16, 0:26:24]: To allow for additional residential uses for seniors around the perimeter of the property. So the 20 acres right now. [0:26:25, 0:26:30]: does allow for um senior units to be developed on the site. [0:26:31, 0:26:51]: But when you look at the location um of the property and I'm gonna look back here again, um we are actually located within um or kind of surrounded by property that is in the city of Stonecrest. And I don't have let me see if I can go back to the staffs. [0:26:51, 0:26:55]: um presentation here. Hold on. [0:26:56, 0:26:57]: Bridge is it? [0:26:58, 0:27:12]: You mentioned Stone Crest, Michelle. Sorry I said Stone Crest, boy. I'm in two different places at one time today. Um at any rate, I can't pull back up the staff's um presentation, but um this property is surrounded by [0:27:12, 0:27:32]: Property located within the city of Stockbridge. And we know from the annexation package that the city has already put together that this is property that the city had actually anticipated trying to move into the city. It is in some ways almost like an island property and therefore. [0:27:32, 0:27:52]: For appropriate for annexation into the city. So that's the first issue that we have before us: is is this property appropriate for annexation? Regardless of the zoning issues surrounding it, what we know is that as an unincorporated island, it really needs to be in the city. And we are volunteering. [0:27:52, 0:28:12]: Voluntarily trying to come into the city versus the city seeking to complete its annexation process where you all have already published information stating that this property is property that the city wants to annex in. So I'm gonna kind of try and stick with that and answer. [0:28:12, 0:28:19]: any questions with regards to the annexation and come back and do the full presentation on the comp plan and the rezoning. [0:28:19, 0:28:39]: What I can tell you is that this will be a 55 and older community that we're seeking to develop on the site. We will be combining this with the additional property that's already located within the city. Um, and that will allow for a comprehensive pro um project under the MU zoning district. So um [0:28:39, 0:28:50]: We'll be happy to answer any questions with regards specifically to the annexation. Um, but I'll wait for my further comments on the rezoning and the comp plan, because I know you all have a long night tonight. [0:28:52, 0:28:53]: Any questions? [0:28:56, 0:29:00]: Oh oh what was the price point. Low three hundreds. [0:29:04, 0:29:24]: Mr. Chairman, may I? Sure. Uh you commented earlier, Miss Bell, and thank you for being here. Um that this particular parcel was slated to be annexed via the referendum that's gonna take place in November. Yes. But in my review of the proposed annexation [0:29:24, 0:29:25]: May up. [0:29:25, 0:29:27]: Unless I'm reading it incorrectly. [0:29:28, 0:29:31]: I'm not seeing this parcel, it's being part of that. [0:29:33, 0:29:53]: Uh yes, uh Mr. Doumas, the property is not slated for the um annexation for the referendum coming in on November 8th. This is just outside of it. Um so yes, you're correct in that. Just this portion that is being requested to be annexed, the piece that's currently there, um that's [0:29:53, 0:30:10]: in the city already, then we're we're good to go. But this particular piece, this additional twenty acres, is not showing as part of the annexation referendum coming up in November. So I just wanted to I don't I don't mean to misspeak, but I uh let me make sure I'm clear. [0:30:10, 0:30:23]: my understanding from a maybe I'm looking at the prior iteration of the annexation map. I thought there were like three or four different areas and that this wasn't a high priority area. There had been two iterations of [0:30:23, 0:30:43]: of this and the most recent is what was recently approved by the governor for us to bring before. Okay, so I apologize for that. Um the original one that I saw did have this property as one of the ones you all were looking to annex in. At any rate, um this property is surrounded by um property that is in the city of Stockbridge. [0:30:43, 0:31:03]: And we would like to bring it in to the city of Stockbridge. One of the main reasons too is because this is an integrated project. Our intent here is to have one total project and not multiple projects. And so I don't think I can get [0:31:03, 0:31:10]: back to my let me see if I can get back to where I was. [0:31:12, 0:31:13]: Oh. [0:31:15, 0:31:23]: I'm gonna ask for a little assistance because I can't seem to get back to that slide. If I can get back to where I was over there. [0:31:39, 0:31:59]: All right. So um when we're looking at the total project for the site, um you can see here that it is one large integrated site. And what we didn't want to have happen is to seek the rezoning on the portion that's already in the city and have to deal. [0:31:59, 0:32:15]: deal with differing jurisdictions with regards to police, fire safety, utilities, those types of things. We wanted all of the project into the city versus having it split between the city and the county. [0:32:15, 0:32:16]: Okay. [0:32:19, 0:32:23]: Okay. Mr. Chairman, I have another question, please. Sure. [0:32:23, 0:32:31]: Uh Miss Battle, uh I'm looking at an ex annexation request, a comprehensive plan amendment. [0:32:32, 0:32:38]: And a rezoning. Correct. And I'm curious to know but I would expect to see uh [0:32:39, 0:32:59]: A recombination request. So and it's not present. I'm curious as to know why. Okay. Um the property in the staff um has already indicated as one of the proposed conditions that be required to do the recombination, which is fine. Um the intent here was to combine the two. [0:32:59, 0:33:10]: But at the time that we submitted the application, there was no indication that we had to do it at that time. But the staff has made that a condition of any approval, and we're fine with that. [0:33:11, 0:33:12]: Thank you. [0:33:12, 0:33:32]: Um again if you all like me to do the full presentation, I can go ahead and do that. I just don't want to be redundant. If I say it now, I don't want to have to say it. I didn't want to have to say it again and again. Okay. Well look let me do this. Let me just let me just do my whole little my whole little moment and then I won't do it again three times. I don't just want to do it for you all three times. [0:33:32, 0:33:52]: Times. So Southern Crescent TBI Center again is a traumatic brain injury rehab facility. And what their goal is on this site is to provide quality senior housing within the city of Stockbridge that is second to none at affordable rates. The plan right now shows as [0:33:52, 0:34:12]: before you shows an age restricted community for 55 and older. You will have to be 55 and older to live on the site. You will not be able to have any children living on the site um if they don't meet the age of 55. So I guess if your older children are 55 and older, they can live with you. But if they are 51, uh they cannot. Um [0:34:12, 0:34:12]: Mm-hmm. [0:34:13, 0:34:33]: What we are intending to develop on the site is 224 townhome units and 52 single-family detached units. The project is integrated with the existing medical facility. There will be access, two access points off of 42, in addition to one access point off of technology. [0:34:33, 0:34:53]: Drive in the back. When you come into the facility, you will come in or to the community, should I say, you will go past the medical facility here in the front, and then you will proceed in to the townhome component of the community that's on the south side of the site. We'll cross [0:34:53, 0:35:01]: Cross over then the stream area into the single family detach section, which is located. Oh [0:35:01, 0:35:15]: It's not showing my little cursor there, but nonetheless. Um you cross over the stream and you're into the single family detach section. And then when you go to the back quadrant of the pri of the site, you're in the area. [0:35:16, 0:35:36]: um where the um other townhomes are located. There are multiple spots within the community for amenity areas. And when we look here, this is a little better view of the individual pods. Again, this is the first pod where the medical facility is at and the town [0:35:36, 0:35:37]: [2139.4, 2145.7]: Then you go into pod two, again where the single family detached units are located, the fifty-two detach units. [0:35:46, 0:35:50]: And then you're back over here where the town home units are located. [0:35:53, 0:36:09]: Um in terms of the site data, when we're looking at um the differentiation between what's in the city and what's outside of the city currently, we have roughly twenty acres um that's um currently located in unincorporated Henry County. That's the portion that we're trying to annex in. [0:36:09, 0:36:16]: Um and then the balance of the twenty two acres is currently located in the city of Stockbridge. [0:36:18, 0:36:38]: We've shown you the elevations. You can see that we actually are offering both one and two-car garage units. So all the units will not be one-car garage. There may be some seniors that are single that don't have a spouse and don't have a need for a two-car garage. There will be parking area in front of their unit. [0:36:38, 0:36:56]: unit, but there will also be two car garage units that will allow two parking spaces as well in front of the unit. You can see here that basically these units are one-story units with the possibility of a loft space above to the extent desired. [0:36:57, 0:37:17]: In terms of the amenity areas, um, they are located um primarily in the two areas that you can see here, one in that back quadrant, what I was calling pod three, um, where we have a cabana and an outdoor um pool area. And then we have the same um feature except um without the pool um on [0:37:17, 0:37:22]: um what would be the um pod one where the um [0:37:23, 0:37:25]: the medical facility is located. [0:37:26, 0:37:28]: In terms of the amenities for this project. [0:37:29, 0:37:49]: Again, we've got two community centers and clubhouses. They'll have a library, a small theater. They may have a community space. They will have a community space where they can have, for example, live music, maybe a little uh jazz quartet or something like that for the residents for entertainment purposes. Um, there'll be a meeting room space and a [0:37:49, 0:38:09]: business center in um the two community um clubhouse areas. There also will be uh heated indoor and outdoor swimming pools available on the site. There'll be walking trails, pickleball courts, a dog park. And this community will be really catered to seniors to reduce their kind of day-to-day [0:38:08, 0:38:28]: maintenance requirements. So 100% of the lawn care will be taken care of by the HOA and the HOA will own all of the amenity areas. There will be a mandatory homeowners association and the only the declarant will be allowed to rent any units on the site. So [0:38:28, 0:38:40]: So there will be zero ability of the residents to actually rent their units. To the extent that there are any units that become available for rent, it would only be rented through the declarant. [0:38:41, 0:38:50]: And then finally, um access to um medical services at the facility that is there would be available to um the residents at a fee. [0:38:54, 0:39:05]: These are some of the interior shots. We've got some that are roughly a little over 1500 square feet, some are a little over 1600 square feet. [0:39:06, 0:39:18]: They all come equipped with um living, you know, um living room spaces, um bedrooms, two bedrooms, um a kitchen, outdoor um seating areas as well. [0:39:25, 0:39:37]: And again, um the facilities, um the the buildings that will be uh developed on site will be a mixture of brick and um hardy plank siding. Um the average unit size will be um sixteen hundred square feet. There'll be [0:39:37, 0:39:57]: units that are two to three bedrooms and they will have um both one and two car garage options. Again, we've got the pools, the community centers, the library, the wellness center there at the existing facilities, the walking trail. And again the price points are in the low 300. [0:39:57, 0:39:59]: Um [0:39:59, 0:40:19]: If this project is approved, um, we would anticipate um the units going into um production by the end of 2023. And again, this will be a 55 and older age restricted community. And we're here to answer any questions that you may have. I would like to answer or you explain it for the benefit of the uh [0:40:19, 0:40:25]: [2426.2, 2446.2]: uh aspects. One the city can go and seek annexation or an individual who owns property can seek annexation to come into the city. Is that correct? That is and that's what this is a hundred percent um request by the owner to come into the city. Come into the city. I just wanted to make that clear for the audience. Yes. We are seeking to come in and come back [0:40:46, 0:40:51]: Combine this with the other property that is adjacent um for the entire forty two acres. [0:40:55, 0:40:56]: Any questions? [0:40:58, 0:41:02]: Are there any questions from the from uh go ahead. [0:41:03, 0:41:04]: And it's development where [0:41:05, 0:41:15]: This is going to be provided coming from Highway 42. Is that going to be a controlled intersection or not? Because you're going to have a four-way intersection there. [0:41:15, 0:41:20]: Also, if there are plans to put in the left left lane left turning lane. [0:41:20, 0:41:22]: Into the solidation rather than [0:41:23, 0:41:31]: As well as the B cell lane coming in opposite direction, because forty-two highways we all know are very heavily traveled. [0:41:31, 0:41:35]: highway and the people are waiting there to turn left to get into the subdivision. [0:41:36, 0:41:38]: So the development is going to cause a huge backup. [0:41:40, 0:41:50]: Understood. Um we have Steve Moore with Moore Bass, who's our engineer here with us um from the engineer company of Moore Bass here with us this evening and I'm gonna ask him to respond to those questions. [0:41:52, 0:42:12]: Happy to. Good evening. Um, the access to 42 will most likely end up being a right in, right out. Um, if only because the there's future plans that GDOT has for Highway 42 that's going to be barrier-separated lanes all the way from the square McDonough to 138. Um, and there [0:42:12, 0:42:32]: gonna restrict access points on 42. In the event that this project is uh approved and GDOT allows it prior to that project being done, it's highly likely that a left turn lane may be warranted. I believe there's probably a condition of maybe recommended condition of zoning that would include a traffic impact study where they would do that analysis and [0:42:31, 0:42:51]: calculate the number of trips to determine if it warrants that. Also GDOT has their own criteria that you have to meet before you can put a left turn lane in. But look definitely a decel lane uh deceleration, a right turn lane, that'll be required regardless. Um the question is just is going to be of a right in, right out, or will we have full access and that's going to be up to GDOT. They're the ones that will absolutely control. [0:42:51, 0:42:52]: [2577.1, 2577.7]: Yes, sir. [0:43:00, 0:43:03]: Oh yeah, we have to. We won't be able to build anything without their approval. Yes, sir. [0:43:08, 0:43:16]: And I guess I should have noted too that we do have the comp plan change. Um, and I'll talk about that I guess when that c gets called. [0:43:24, 0:43:28]: Is there anyone from the audience who would like to speak for or against the project? [0:43:30, 0:43:33]: Yes, sir. Would you approach the podium? Provides with your name and address. [0:43:36, 0:43:55]: Good evening. Thank you for allowing me to speak. My name's David Perry. I'm a lifelong resident of Henry County. Went to elementary school across the street, graduated from Stockbridge High School in 1978. I own businesses and property adjacent this proposed development, and I have serious concerns, especially about the northernmost. [0:43:55, 0:43:56]: Tracked. [0:43:57, 0:44:00]: Now my business has been in Henry County since nineteen ninety nine. [0:44:00, 0:44:07]: When we needed to expand and relocate in two thousand seven, I had to look for M one zone property. [0:44:07, 0:44:11]: light industrial which is what is appropriate for what we do [0:44:11, 0:44:31]: My primary company, Hydraulic Circuit Technology, manufactures and installs hydraulic systems on very large demolition and earth-moving machinery. We fabricate metal, we sandblast, we powder coat, we take delivery of excavators and other large machinery. This is an industrial environment. [0:44:31, 0:44:51]: uh and we've been there for 15 years. Now when I went shopping for property, I wanted to be in Henry County where my home is and um but there was very little property with the correct zoning so I was kind of limited in what I could find. So I really had to go shopping to find the appropriate piece of property. [0:44:51, 0:44:52]: Yeah. [0:44:53, 0:44:57]: А пай сортова преміум токені екс да перчат. [0:44:58, 0:44:59]: At that location. [0:44:59, 0:45:19]: And it's zoned M1. We like the name of the road, Technology Parkway, which is appropriate for our business, Hydraulic Circuit Technology. I put in a road at the end of Technology Parkway, public road, named it Fluid Drive, because my company's in the fluid drive industry. [0:45:19, 0:45:24]: We have every reason to think this is going to be industrial area. [0:45:24, 0:45:44]: And uh we've conducted business there in good times and bad now for 15 years. Our main building is a 40,000 square foot manufacturing facility where I employ 55 people, including company president and Henry County resident Mr. Nabeen Beliga, who's here with me tonight. And last year. [0:45:44, 0:46:04]: We completed construction of another 16,000 square foot building located at 225 Fluid Drive. They don't show that building on any of their drawings in the package that we received. But I have three lights there that are just to the north of this northernmost tract. [0:46:07, 0:46:25]: So the traffic, and I appreciate your questions about it, those are some of my questions about how the traffic will be handled. It's already terrible for for me and my employees to get out of technology parkway, especially those of us that need to turn north. Naveen and I had to do what we typically have to do. [0:46:26, 0:46:46]: Which is turn south on 42 and go down however far we have to to find somewhere we can turn around to go back north. And it's that way every afternoon because it's the overflow that I-75 can't handle. There were plans that I've seen many years ago where there was going to be a traffic light there, but I actually approached G DOT a couple of years. [0:46:45, 0:46:57]: couple of years ago when they were talking about their plans for Highway 42 and they they absolutely shot down the idea of putting a traffic signal there. [0:47:00, 0:47:20]: We are uh we have a McDonough address there and we are in unincorporated Henry County. Uh it would be a terrible burden on our business to have to change addresses. Prior to being at that McDonough location, we were in the Hudson 75 business park, which has a stockbridge address. Uh that was usually [0:47:20, 0:47:26]: Years ago, but it was a terrible problem for us to have to change all of our uh [0:47:27, 0:47:47]: all of our business materials t to a new address and especially to get our thousands of vendors and customers to change and to understand that we had moved. So that just that address change alone would be a terrible inconvenience for us. Um but if this development proceeds [0:47:47, 0:47:52]: the way it's designed, twenty five units of that high density housing [0:47:52, 0:48:04]: will back up to three of my commercial lots. And some of the machinery we operate's really loud. We often operate a second shift at night. Um [0:48:04, 0:48:10]: It's really just not appropriate for a high density residential. Um [0:48:11, 0:48:25]: Yeah, that's a pretty drastic change to go from light industrial to high density residential there. And uh I don't think we'd be happy and I don't think maybe the people that would be living there would be happy. [0:48:25, 0:48:26]: So um [0:48:28, 0:48:48]: We do have grave concerns about this. Um one of the things this annexation attempt will do is uh I think Miss Battle referred to the fact that it it's sort of an island there. My business will definitely be on an island, an unincorporated area in an island, which is mine. [0:48:48, 0:48:57]: understanding that's really not acceptable. Uh and and so I what I think is we might be forced into an annual. [0:48:57, 0:48:59]: I see. Okay, thank you so much. I appreciate it. [0:49:01, 0:49:02]: Thank you. [0:49:03, 0:49:04]: Is there anyone else who'd like to speak? [0:49:05, 0:49:06]: In opposition. [0:49:06, 0:49:07]: In opposition. [0:49:12, 0:49:19]: Hello, my name is Dion Roberts and I live in uh Lakes Barbie Country Club. Um just a few [0:49:20, 0:49:30]: weeks ago b I believe you guys just approved or not the same board but uh three hundred apart um townhomes and a hundred uh uh [0:49:30, 0:49:39]: Um I'm sorry, 300 apartments and a hundred townhomes right across the street, right there at that intersection. Wait a minute. I I are you speaking about this project here? [0:49:40, 0:49:48]: Yes. That's this pro yes. Is that the this the project that's right there on uh Spider Road on um 138? This is on 42. [0:49:49, 0:49:51]: Okay, I'm sorry. Well this is something different. I apologize. [0:49:52, 0:49:53]: Anyone else? [0:50:01, 0:50:05]: Is there anyone else like to speak pro or for or against the project? [0:50:07, 0:50:08]: I hearing none. [0:50:10, 0:50:15]: Um I have a motion regarding the application from the board, yeah. [0:50:20, 0:50:22]: I'd make a motion that [0:50:23, 0:50:30]: I make a motion that we review this project and decide how we wanna go with it. Um [0:50:32, 0:50:34]: that we approve this project. [0:50:34, 0:50:37]: That would be my motion. Second. [0:50:39, 0:50:42]: Mr. Chairman, may I question uh point of order? [0:50:43, 0:50:55]: Are we talking strictly just the annexation or are we voting on the entire project? At this point, we strictly speaking about the annexation. Uh that is the [0:50:55, 0:51:07]: The project cannot go forward without the annexation. And you can't get the rezoning, et cetera. So it's a step by step process. We approve the annexation, you make through the recombination, rezoning, etcetera. [0:51:08, 0:51:16]: So the motion that was the that's on the table is for the annexation. Only okay. And it's been second. [0:51:18, 0:51:30]: Okay. Uh Miss Ms. Logan, the uh motion has been uh provided by Mr. Tibodeau. It's been second by Mr. Doomis. All those in favor, let it be said. Pardon me? Mr Horn seconded. [0:51:30, 0:51:41]: I'm sorry, Mr. Horne seconded. Um all those in favor let it be known by the sign of aye. Aye. Those opposed, ayes have it. The annexation application is approved. [0:51:45, 0:51:48]: The second case is item CP twenty twenty two oh two. [0:51:49, 0:52:02]: So comprehensive plan amendment for case number CP 2022, the City of Stockbridge Planning Commission and the City of Stockbridge, Mayor and Council will hear a comprehensive plan amendment request by S3 Capital Investment LLC. [0:52:04, 0:52:06]: The applicant represented by the ballot PC, the agent. [0:52:07, 0:52:10]: To change the future land use designation of certain parcels [0:52:10, 0:52:17]: as I described below, from light industrial and mixed use to high density residential in order to allow an age restricted [0:52:17, 0:52:18]: Residential development. [0:52:21, 0:52:25]: The uh parcel is zero seven one. [0:52:25, 0:52:30]: Zero one zero three four zero one four located within the stockbridge city limits. [0:52:31, 0:52:35]: Which frontage on highway forty two and situated at the end of Technology Parkway. [0:52:35, 0:52:40]: African proposes to change the current land use designation from light industrial to high density residential. [0:52:41, 0:52:42]: Contains twenty two point one. [0:52:43, 0:52:46]: Plus or minus acres located in landlord thirty one district seven. [0:52:48, 0:52:50]: The other parcel is zero seven one zero [0:52:51, 0:52:53]: one zero three four oh one two. [0:52:54, 0:52:58]: Subject property is an unincorporated Henry County which frontage on Highway forty two. Excuse me. [0:52:59, 0:53:05]: Cross from Summit View Drive, applicant proposes to change the current county land use designation of mixed use. [0:53:05, 0:53:17]: to the s to to the city land use designation of high intensity residential after the parcel is annexed into Stockbridge city limits contains twenty plus or minus acres located land lot thirty thirty one. [0:53:18, 0:53:19]: of District Seven. [0:53:21, 0:53:22]: Staff would now present item two. [0:53:54, 0:54:01]: Okay. This is a co proposed comprehensive plan amendment again for the proposed Southern Crescent uh mixed [0:54:01, 0:54:02]: Residential development. [0:54:03, 0:54:05]: We have some of the same slides in here. [0:54:06, 0:54:07]: Um to [0:54:08, 0:54:08]: The [0:54:09, 0:54:12]: First track par tract one and then this is [0:54:13, 0:54:16]: Aerial photograph of track two to to the north, irregular shaped [0:54:17, 0:54:17]: Property. [0:54:18, 0:54:20]: It shows highway forty two here. [0:54:20, 0:54:26]: And technology parkway um dead ending in this at the end of the street here at this parcel. [0:54:29, 0:54:33]: So the applicant is requested to change a future land use designation. [0:54:34, 0:54:34]: Um [0:54:34, 0:54:38]: Of the parcels from light industrial and low [0:54:38, 0:54:46]: Density vertical mixed use and mixed use to high density residential. So you've got three different uh designations right now. [0:54:46, 0:54:47]: The um [0:54:47, 0:54:49]: parcel in the city as [0:54:50, 0:55:01]: mixed use and then the parcel in the parcel in the county to be annexed is mixed use and the parcel in the city low light industrial and low density vertical mixed use. So both parcels [0:55:01, 0:55:03]: Applicant wants to change to [0:55:03, 0:55:07]: High density residential. Okay. [0:55:08, 0:55:09]: Gone over some of this. [0:55:11, 0:55:12]: [3318.8, 3324.2]: Uh the the recombination of the two parcels uh would be needed as was discussed before. [0:55:28, 0:55:29]: Um [0:55:31, 0:55:33]: I'm not gonna go over all of this. [0:55:34, 0:55:35]: This is uh [0:55:36, 0:55:38]: Survey of the second parcel to the north. [0:55:38, 0:55:40]: Um you can see the regular shape there. [0:55:42, 0:55:47]: So again this is the um Henry County zoning map. It's zoned um [0:55:47, 0:55:48]: M U on the [0:55:49, 0:55:50]: Parcel to be annexed. [0:55:51, 0:55:53]: And then the parcel in the in the city. [0:55:54, 0:55:54]: Um [0:55:59, 0:56:02]: So in our analysis, um the [0:56:02, 0:56:10]: Proposed development is not consistent right now with the comprehensive uh plans, land use designations for the property, and that's of course the reason why. [0:56:10, 0:56:13]: applicant has applied for comprehensive plan [0:56:13, 0:56:14]: uh amendment. [0:56:14, 0:56:20]: Um the existing designations do not allow for the proposed uh residential development. [0:56:21, 0:56:21]: Um [0:56:23, 0:56:30]: So the track one would be uh changed uh from mixed use to uh PUD zoning. [0:56:31, 0:56:33]: And uh track two. [0:56:33, 0:56:37]: uh would be changed from office institutional and light industrial [0:56:37, 0:56:38]: again to PUD. [0:56:39, 0:56:48]: Um now of course there's no need to change a land use designations if the property is not also rezoned, which is the subject of our next application tonight. [0:56:50, 0:56:51]: We feel that the [0:56:52, 0:56:58]: Property is suitable. The s the site is suitable for the proposed high density land use designation because [0:56:59, 0:57:07]: Adjacent uh properties, uh existing subdivisions also have a land use designation of high density residential. [0:57:08, 0:57:08]: Um [0:57:09, 0:57:09]: And [0:57:10, 0:57:11]: The track one is already developed. [0:57:12, 0:57:13]: And um [0:57:14, 0:57:19]: uh track two additional industrial uses could be developed but because of the regular [0:57:19, 0:57:24]: shape of the property. Um, we feel that that is not not likely to happen. [0:57:31, 0:57:40]: So we recommend a conditional approval of this proposal, um, conditioned upon the recombination of the two parcels, and that could be handled. [0:57:41, 0:57:43]: administratively by the staff in the office. [0:57:45, 0:57:46]: This would require uh [0:57:47, 0:57:48]: applicant convinced to submit a [0:57:49, 0:57:50]: Official [0:57:50, 0:57:53]: Plat to be drawn by a surveyor or or engineer. [0:57:54, 0:57:55]: And that would then be [0:57:56, 0:57:59]: Recorded at Henry County Superior Court in the real estate division. [0:58:01, 0:58:05]: And so the uh property that's adjacent to it. [0:58:05, 0:58:06]: is already high density. [0:58:07, 0:58:08]: Residential. Is that what you're saying? [0:58:09, 0:58:11]: Uh to the south. To the south. Right. [0:58:12, 0:58:12]: All right. [0:58:17, 0:58:18]: Any questions from the board? [0:58:22, 0:58:24]: Mr. President, can I speak? [0:58:24, 0:58:25]: Sure, go ahead. [0:58:26, 0:58:33]: Uh Miss Logan on this property uh they also have an area of railroad tracks, uh [0:58:34, 0:58:39]: where this property is located. And also if he's having a um [0:58:40, 0:58:48]: commercial property next to it, uh are we looking at some type of sound barrier also for uh to uh put between those [0:58:49, 0:58:51]: Commercial property and residential. [0:58:51, 0:58:53]: Which commercial property? [0:58:54, 0:58:56]: I'd have to look at it on the map to show you. [0:58:58, 0:58:59]: The one to the north. [0:59:01, 0:59:09]: Hi his th that's correct, his three lots. Uh how far's the train tracks from your three lots, may I ask? Uh [0:59:12, 0:59:18]: See those those are some of the things that wasn't mentioned, uh, as far as that property is concerned. [0:59:18, 0:59:22]: And then also if if this property does get approved or it doesn't get approved. [0:59:23, 0:59:28]: Uh there still needs to be some form of sound barrier against the uh commercial property. [0:59:29, 0:59:39]: You you mean the industrial property that you Yes, the the industrial property, that's correct. Perhaps the applicant would like to speak to the site design and buffering and those issues. [0:59:43, 0:59:44]: Yeah, the applicant come forward. [0:59:45, 0:59:49]: Sorry. I see can you have the applicant come forward to address that? [0:59:49, 0:59:52]: Miss Battle, would you like to speak again? [1:00:26, 1:00:32]: Okay, sorry. I'm just trying to make sure I'm oriented to the property. On the property, yeah. [1:00:36, 1:00:38]: Ms. Battles, are you ready? Yes. [1:00:40, 1:00:48]: I was asking about a sound barrier for the uh commercial property or the industrial property, uh, for the area that you're trying to [1:00:49, 1:00:51]: Speak to us a mile. [1:00:51, 1:01:11]: So with regards to um um the issues that were raised, um we have not had an opportunity to speak with the adjacent property owner and certainly we we're more than happy to do so. Um we do we are providing a 30-foot buffer along the rear perimeter of the site um to the extent that we need to have conversation with [1:01:11, 1:01:31]: With our architect regarding sound walls and that type of thing on the project. We can certainly do that now that we have a little better feel for what is transpiring on the site. I can only tell you that Southern Crescent has been located in that particular location for the last 14 years, and they have not. [1:01:31, 1:01:49]: not experienced any issues over there. It may be the distance that they are from you all now, but they have not experienced any issues and therefore did not foresee any issues for the residents. Obviously they're very sensitive to that particular issue. And so we will definitely take that into consideration. [1:01:50, 1:01:50]: Good. [1:01:51, 1:01:52]: All right, thank you. [1:01:55, 1:01:57]: Any other questions? [1:02:06, 1:02:07]: Any other questions? [1:02:12, 1:02:18]: Uh anyone from the audience the uh would like to speak for or against the project? [1:02:19, 1:02:21]: Mobile speaker here. Sure. [1:02:27, 1:02:43]: I do feel that we were somewhat neglected in this. Somewhere in the package it mentions the necessity of perhaps providing fencing between their prop proposed project and the subdivision to the south, but our property to the north completely ignored. [1:02:43, 1:02:44]: Um [1:02:45, 1:02:47]: And uh I also want to mention about the [1:02:48, 1:03:08]: I'm I'm no attorney by any stretch. Uh but as far as the age restricted property, uh as I understand it, as long as one person in the home is over the age of fifty five, that's that's what the law requires and allows. So uh I don't think it's gonna be the case that these are all older people. [1:03:08, 1:03:14]: Um so I I think it might be mischaracterized a bit. Thank you. [1:03:17, 1:03:19]: I'd like to respond to that. [1:03:20, 1:03:20]: Mm. [1:03:23, 1:03:24]: Go ahead, Ms. Valley, you wanna address that? [1:03:25, 1:03:37]: Um yes. Um under the bylaws in the declaration we can restrict the property. I'm not sure um that he is aware that that is possible for us to restrict to fifty-five and older. Um and uh [1:03:38, 1:03:58]: You know, at the end of the day, we have a very clear picture of what it is that we're trying to achieve on this site. We recognize that he is concerned um about what may take place and the conflict between what he perceives as the conflict between the two. Um typically um high density residential next to light industrial is not um problematic. [1:03:58, 1:04:18]: You can see that in many spaces and places. Um, usually not a pure single family detach with um large lot development, but this is a smaller um townhome community, and so that is not unusual for those two to coexist. Staff has certainly looked at that issue. Um, we're not doing anything that's gonna impact. [1:04:18, 1:04:38]: His marketing of his property. His property will not be impacted in any way from an addressing perspective with his clients and the like. We're annexing our property in, which is not even a butting. The piece that we're butting, that we're annexing in doesn't [1:04:38, 1:04:52]: doesn't even but his property. Um it the property we have is already in the city of Stockbridge. So um I'm not sure where um that component of this came from. But we have no problem having some conversation and dialogue there. [1:04:53, 1:04:56]: Okay. Mr. Plot uh uh Mr. Plotin, you had a question? [1:04:59, 1:05:02]: Sir, would you approach the podium again? He has a question for you. [1:05:06, 1:05:10]: Just like you mentioned on the m maps that they show, they do not show [1:05:13, 1:05:14]: They show one of the two. [1:05:15, 1:05:15]: Yeah. [1:05:23, 1:05:37]: Uh their thirty foot buffer would would my parking lot would butt up against that in my building. Um they had a site plan up I don't I can't navigate this, but they had a site plan that uh [1:05:39, 1:05:45]: Yeah, I don't I don't think I'm gonna be very successful with this. Um [1:05:48, 1:05:51]: Oh uh yeah, I believe that is a thank you. [1:05:58, 1:06:04]: There it is. Is it possible to operate a cursor on that? [1:06:06, 1:06:12]: Is this still the same? That's it. No. That's that's what he wants there to slightly. No, the aerial photo. [1:06:14, 1:06:15]: Mm. [1:06:15, 1:06:21]: Your property happy. That's right. You can you can see the very northernmost building here is my main building. [1:06:21, 1:06:26]: There's a lot just to the south of that where I constructed another building last year. [1:06:26, 1:06:30]: And then there's a third lot that I plan to develop. [1:06:30, 1:06:31]: There uh [1:06:31, 1:06:51]: butts up against uh technology parkway. So that triangular shaped piece there, um, and then you can see the length of that straight blue line, which is their thirty foot buffer, uh, it so it runs up against a long section of my property. And and there would uh [1:06:51, 1:07:00]: But based on their drawings, there would be 25 residential units that contact my property line there. [1:07:02, 1:07:14]: So we've been able to provide um uh visual. Um it appears to be um our engineer. If that's if that's the building that we're talking about right there. [1:07:14, 1:07:27]: Yes, that's my main building and this is the one I built last year that was not in the package. So building to building is approximately two hundred and seventy five feet horizontally. Steve, if you go to the mic, please. I'm sorry. Thank you. [1:07:28, 1:07:35]: Uh based on the just this exhibit that Michelle's holding up, from the from the new building to the uh [1:07:36, 1:07:49]: approximate location of the proposed rear of of the proposed buildings, about two hundred and seventy s five, two hundred and seventy six feet. Um thirty of that, which would be the existing vegetation that's there, which is very heavily wooded right now. Okay. [1:07:53, 1:07:57]: I appreciate that. There wouldn need to be one in my opinion. Thank you so much. No problem. [1:08:02, 1:08:04]: Anyone else to speak for against the property? [1:08:06, 1:08:10]: Hearing none, uh may I have a motion on the project? [1:08:11, 1:08:12]: Mr. Chairman. [1:08:13, 1:08:14]: May uh [1:08:14, 1:08:18]: Uh earlier I raised the question of recombination. [1:08:19, 1:08:23]: And I did that for a reason. I I in my honest opinion [1:08:24, 1:08:31]: I think recombination, zoning changes, comprehensive plan, amendments. [1:08:33, 1:08:40]: All of those things would be premature until the annexation process has been completed. [1:08:40, 1:08:46]: And as we see it, we don't know what the city council is gonna do with respect to indexation. [1:08:47, 1:08:50]: So I I'm gonna recommend or make a motion that we [1:08:51, 1:08:51]: Postpone. [1:08:52, 1:08:54]: The comprehensive plan amendment. [1:08:55, 1:09:15]: And the reson until the annexation process is complete. Mm mr. The only thing that we're doing here is make a making a recommendation to the city council. It's up to the city council to approve it. We can't approve it. The only thing we can do is recommend that we've had a public hearing, that uh these the the the issues have been addressed. [1:09:15, 1:09:24]: Addressed and that we're making the recommendation based on the facts that we have before us today. It's up to the city council to approve it. Go ahead, Miss U [1:09:24, 1:09:44]: That that's correct, Chairman. Um so Mr. Dumas, the all three items will have to go to the city council for approval. They do require a recommendation from this board in order to move forward with their decision. So it would be required for you all to because we would s we would be back. [1:09:44, 1:09:55]: back in a loop because you all would have to make a recommendation on the annexation, the comp plan amendment, and the rezoning in order for this city council to make their final decision on all three. [1:09:56, 1:10:04]: And Mr. Doom is if you look at the project, we're repeating the same uh lock configuration over and over because they're trying to do [1:10:04, 1:10:05]: The zoning, the [1:10:06, 1:10:08]: Recomposit recombination. [1:10:08, 1:10:13]: annexation, et cetera. One can neither of these pieces can go forward without the others. [1:10:17, 1:10:37]: I was going to say, if you don't mind my interjecting. Um, with regards to the annexation, no annexation can come in without it being zoned. So the zoning and the comp plan chain have to take place concurrently with the annexation. All three have to occur together because we're asking for a change from what is currently in place. [1:10:37, 1:10:38]: Yeah. [1:10:38, 1:10:47]: So all three have to be taken together. So if the ant we go to city council and they deny the annexation, then the zoning and the comp plan change goes away. [1:10:49, 1:10:52]: If they approve the annexation, they have to approve that annexation. [1:10:52, 1:10:55]: with the zoning and the comp plant component. [1:10:55, 1:10:57]: And I believe if I'm not mistaken, we still have. [1:10:58, 1:11:07]: uh to get uh approval from Henry County as well. That's correct. So uh we're not the only one that's reviewing this. Henry County is reviewing it as well. [1:11:07, 1:11:11]: So only thing we can do is make a recommendation based on the facts that we have. [1:11:11, 1:11:15]: And uh recommended to city council again, as I stated. [1:11:15, 1:11:19]: Uh Henry County the zoning will have to go over this and approve it as well. [1:11:19, 1:11:20]: That's correct. [1:11:20, 1:11:20]: Okay. [1:11:22, 1:11:23]: Any other questions? [1:11:25, 1:11:26]: Might have a motion. [1:11:31, 1:11:32]: Not everyone at once, no. [1:11:33, 1:11:36]: Make a motion that we approve the comprehensive plan amendment. [1:11:37, 1:11:39]: I have a second. A second. [1:11:40, 1:11:48]: It's been moved by Mr. Horns and second by Mr. Tibetal. All those in favor, let it be known by the sign of aye. Aye. Aye. Those opposed? [1:11:48, 1:11:49]: All right. [1:11:50, 1:11:57]: Hearing uh one opposition, the uh eyes have it, the application is approved. [1:11:59, 1:12:02]: The third case in in um on the pardon me? [1:12:03, 1:12:06]: Who w who was the person the board member in opposition? [1:12:07, 1:12:11]: It was uh mo moved by Mr. Horns and second by Mr. Tividal. [1:12:11, 1:12:24]: Right. Did you say in in the boat itself there was um Yeah, one Mr uh um Dumas opposed it. Dim okay, thank you. Okay. [1:12:24, 1:12:27]: Five minutes and vote, and I want to change my vote. [1:12:30, 1:12:39]: Okay. Uh Mr. Plashon wants to change his vote. Uh that being the case, I vote for approval, so the eyes have it. [1:12:42, 1:12:54]: The third case is rezoning case RZ 202202. The City of Stockbridge Planning Commission and the City of Stockbridge Mayor and City Council will hear a rezoning request by S3 Capital Investment LLC. [1:12:54, 1:12:56]: The applicant represented by the battle PC [1:12:57, 1:13:01]: The agent to rezone industrial in the city of Stockbridge city limits [1:13:01, 1:13:06]: А миксюс на уникопенри какие то план универман. [1:13:07, 1:13:12]: To allow for an age restricted residential development. The property contains two parcels [1:13:12, 1:13:13]: As are listed below. [1:13:14, 1:13:17]: With forty two point oh one plus or minus total acres. [1:13:21, 1:13:23]: The staff will present the item for me, please. [1:13:43, 1:13:44]: Okay, this is [1:13:45, 1:13:52]: This is for the proposed rezoning R Z twenty twenty two oh two for the Southern Crescent uh development. [1:13:57, 1:14:02]: So right now we have two zoning classifications and the [1:14:03, 1:14:07]: Applicant would like to rezone from mixed use in unincorporated Henry County. [1:14:07, 1:14:08]: Uh and then [1:14:09, 1:14:15]: OI office institutional and L I Light Industrial in the City Stockbridge portion. [1:14:16, 1:14:23]: And would want to rezone both parcels to PUD plan unit development to allow for this proposed development. [1:14:29, 1:14:30]: Okay. [1:14:36, 1:14:41]: We have already covered the fact that the proposed development is not consistent with the comprehensive plan. [1:14:42, 1:14:43]: And that's the reason for the [1:14:44, 1:14:45]: That application. [1:14:45, 1:14:47]: The rationale for the rezoning um [1:14:49, 1:14:51]: It is necessary because the proposed development re [1:14:51, 1:14:53]: include both attached and detached. [1:14:54, 1:14:55]: Residential units. [1:14:55, 1:14:58]: as well as the existing uh rehabilitation center. [1:14:59, 1:14:59]: Um [1:15:01, 1:15:06]: They have been advised to rezone a PUD rather than M FR, which is multiple family residential. [1:15:06, 1:15:09]: Um because mainly the presence of the [1:15:10, 1:15:12]: Southern Crescent facility to be included. [1:15:13, 1:15:16]: Um and then the floodplain areas uh because [1:15:17, 1:15:23]: The site needs flexibility in site design and the PUD allows more flexibility than the MFR district. [1:15:24, 1:15:28]: А ви філбі пропе потріл позитив ефекс. [1:15:28, 1:15:33]: of this development and the rezoning will be compatible. You do have MFR zoning. [1:15:33, 1:15:35]: Uh to the west, south and east. [1:15:36, 1:15:37]: in adjacent subdivisions. [1:15:38, 1:15:45]: And uh this would also be a good transition with the adjacent L I and OI districts to the north. [1:15:45, 1:15:51]: And PUD would be compatible similar to Henry County's mixed use uh designation for track one. [1:15:53, 1:16:01]: Villa site is suitable due to its un unusual shape of of the track two and the uh Wolf Creek tributary. [1:16:01, 1:16:07]: Um there may be some challenges in the site design and a bridge is needed over the creek, as I mentioned. [1:16:08, 1:16:08]: Um [1:16:09, 1:16:10]: You feel this would be [1:16:10, 1:16:13]: positive impacts on adjacent residential uses. [1:16:14, 1:16:16]: Um I mentioned before the [1:16:16, 1:16:25]: uh need for site improvements, some improvements to the sewerage system, um the traffic uh and transportation impacts we've covered [1:16:25, 1:16:26]: Let's see. [1:16:29, 1:16:38]: Uh the proposed development qualifies for a PUD district because it meets the requirement that PU districts contain at least two types of residential uses. [1:16:39, 1:16:46]: Um it would also further the objectives of the parkway mixed use overlay district. This both parcels are in that overlay district. [1:16:46, 1:16:50]: because of their frontage on highway forty two north. [1:16:50, 1:16:54]: So this could be an attractive gateway into the city. [1:16:54, 1:16:55]: Um [1:16:56, 1:17:00]: as far as being able to develop under the present zoning, um [1:17:00, 1:17:02]: There could be some uses um [1:17:03, 1:17:08]: But this would be uh attractive development that we feel would be compatible with the area. [1:17:12, 1:17:14]: We recommend approval with conditions. [1:17:15, 1:17:29]: Uh we've identified um five conditions. We've discussed the annexation approval would be one, the comprehensive plan amendment approval as was mentioned, all three need to go hand in hand. Also the recombination of the two parcels [1:17:29, 1:17:30]: And then finally [1:17:31, 1:17:31]: Uh um [1:17:32, 1:17:32]: Well [1:17:33, 1:17:35]: based on the conceptual site plan. [1:17:36, 1:17:38]: The final plan would need to be similar to this one. [1:17:38, 1:17:48]: and then the water and sewage uh improvements uh that would be needed that I discussed before. So we have these five uh recommended approved conditions. [1:17:53, 1:17:53]: That it [1:17:54, 1:17:54]: Mm. [1:17:55, 1:17:57]: Have the applicant come forward. [1:18:06, 1:18:14]: We are um in favor of the conditions proposed by staff. I won't um be redundant in comments. If you all have any questions for me, I'd be happy to answer them. [1:18:14, 1:18:20]: We don't have any I don't have any questions, Miss Balor. I I I think that w what maybe you need to explain to [1:18:20, 1:18:40]: the uh public that's here that uh we're redundantly going over the same parcels of land, simply addressing them in dis d different aspects to combine them all. So if you could turn around maybe make that clear to them so they understand so it's not something yes. Um this application um is a part of [1:18:40, 1:19:00]: The other two, we in order to be able to bring this project to fruition, we have to annex the 20 acres in, which is the first application we dealt with. We have to change the comprehensive plan to adapt to all both parcels so that there is consistency there between the two. [1:19:00, 1:19:20]: Because currently there are multiple land uses applicable to the two properties. And then thirdly, we have to rezone the entire project to PUD to allow for a plan unit development. And so that is what the rezoning application is about. We've already described the project. And if the PUD is recommended for approval. [1:19:20, 1:19:31]: we can move forward with the development um in in a cohesive manner as opposed to having these individual parcels um that have no um kind of consistency between the two. [1:19:32, 1:19:34]: Okay. Thank you. Mm-hmm. [1:19:37, 1:19:40]: Does anyone uh wanna speak in favor or in opposition to the project? [1:19:43, 1:19:44]: Anyone. [1:19:45, 1:19:48]: Hearing none, does the board have any questions? [1:19:49, 1:19:53]: I think we've gone over that. I mean I have a motion. [1:20:02, 1:20:04]: I'll make a motion. So [1:20:05, 1:20:19]: I make a motion that uh we approve from a MFR, which is a multifamily resident, to a planned unit development for that particular site. [1:20:20, 1:20:21]: Have a second. [1:20:21, 1:20:22]: Second. [1:20:22, 1:20:27]: It's been moved by Mr. Thibodeau and second by Mr. Horns that the applicant be approved. [1:20:28, 1:20:36]: All those in favor, let it be known by the sign of aye. Aye. Those opposed, hearing none, the ayes have it. The application is approved for recommendation. [1:20:36, 1:20:38]: Seven, are there any that are opposed? [1:20:39, 1:20:47]: Pardon me? Do we have any votes that are opposed? I I did say I oppose. Oh, did you you oppose this? I did. We have one opposed uh Mr. Dumas opposes it. [1:20:55, 1:21:05]: Fourth case is the rezoning case RZ 202203. The Stock Bridge Planning Commission will hold public hearings on Thursday, August 25th, 2022 at 630 p.m. [1:21:05, 1:21:25]: And the Stockbridge City Council will hold a public hearing on Monday, September the 12th at 6 o'clock p.m. in the Stockbridge City Hall, 4640 North Henry Boulevard, Georgia, in consideration for the request and changing from R R Rural Residential District to OR Office. [1:21:25, 1:21:27]: was anti uh institutional district. [1:21:28, 1:21:37]: for uh n point nine six four acres at thirty eight eighty four Walt Stevens Road and land lot twenty five, section twelve, comprising [1:21:40, 1:21:48]: Comprising parcel numbers O thirty one zero two zero one two thousand applicant by CK Commercial Properties. [1:21:48, 1:21:50]: Uh LLC. [1:21:51, 1:21:54]: Uh co counsel is uh oh care of, I'm sorry. [1:21:55, 1:21:59]: Battle PC entry parties may attend the public hearing. Staff would present the item, please. [1:22:30, 1:22:40]: Sorry, right there is I think she snatched Pardon me. I said I'm about to start. She snatched the um flash driver out and it's causing some issues. Okay. Uh just wants to uh [1:22:47, 1:22:51]: Yes it w it was snatched out instead of taken out safely. [1:22:53, 1:22:56]: I think I no actually you know what they use my flash drive. [1:22:56, 1:22:58]: No, I'm talking about Lundel. Okay. [1:23:15, 1:23:16]: Yeah. [1:23:34, 1:23:40]: Sorry about that. Uh I really need those presentations, but uh she she needs to bring her uh [1:23:40, 1:23:50]: drive back. But anyway I'll just proceed for the sake of time. Um the current application before us is a rezoning um for um [1:23:52, 1:24:12]: a speech um therapy facility. Um the future land use designation of the subject property is pu public institution. The subject property is part of a of the mixed of the Parkway mixed use overlay district. The subject property has previously been a church known as the Anointed Prayers of Faith and Masonic Lodge. [1:24:12, 1:24:32]: The building was constructed constructed in nineteen seventy. Surrounding land use and zoning. Property located to the north is the church and its zone MFR. Property to the south of the subject properties, the Red Oak Elementary School and its zone PUD Plan Union Development. Property to the east of the subject properties, the Red Oak United Methodist Church. [1:24:32, 1:24:52]: Church and its zone RR, Rural Residential District. Property to the West is the House of Prayer and Fellowship, Practical Learning, Abel Lee College Preparatory Academy, and its zone RR. The request to resone the subject property to OI is consistent with the current comp plan, which designates the property for public institutional. [1:24:52, 1:25:12]: Land uses. The possible impact upon adjacent property owners, should the property be rezoned, is a small increase in vehicular traffic. The subject property has frontage on Walt Stevens Road, which is a local road. Therefore, there should be a minimal impact on adjacent thoroughfares with pedestrian and vehicle, vehicular traffic. [1:25:11, 1:25:31]: Traffic. Rezoning the subject property will not affect the character of Walt Stevens Road. The location of the proposed speech therapy facility will benefit Red Oak Elementary School since it will help students who have difficulties with speech therapy. The site appears to be suitable for the proposed rezoning with approved variances. Issues regarding buffering to [1:25:31, 1:25:51]: Topography, drainage, drainage, access, size, and shape of the property will be addressed. Variance requests will be heard concurrently. We will hear the variance request right after this case. The applicant will be seeking approval for the following variances. A variance to reduce the minimum lie width from 125 feet to 96 feet. A variance to reduce the eastern [1:25:51, 1:25:53]: [5155.0, 5175.0]: From fifty to zero feet and three feet. And number three, opinion variance to reduce the western section of the property from fifty feet to zero. Staff recommends approval with conditions of the proposed rezoning from R residential rural residential to OI office institutional with the following condition. [1:26:15, 1:26:18]: approval of the three variance varences that will be heard later. [1:26:21, 1:26:27]: Okay. Is the applicant present? Yes, yes, sir. Stop. [1:26:34, 1:26:34]: Oh sorry. [1:26:57, 1:27:17]: Good evening again, Michelle Battle, representing the applicant. Once again, as stated by staff, we are seeking to rezone the property from rural residential to OI, along with the three variances for a children's speech therapy facility. We can see here on the slide, which outlines what staff has already indicated. [1:27:17, 1:27:37]: That this property is surrounded honestly by non-residential uses. We have a church on one side and school facilities on the other. This is a picture of the building as it stands currently. As you can see again. [1:27:37, 1:27:57]: Again, we're not surrounded by any residential uses, despite the fact that those other buildings have the rural residential zoning designation. We can see here again this parcel surrounded on these two sides by rural residential and the PUD in the rear. And then we've got C1 and C2 along this wall. [1:27:57, 1:28:11]: Walt Stevens Corridor. So quite honestly, all of these parcels could be rezoned to O and I, but they are not all included in this application because we only have site control over the one piece that is currently owned by the applicant. [1:28:12, 1:28:32]: What we are seeking to do again is to readapt the property from what had been a church building that had been used for, I would assume, uh office space and um other uh church-related activities to convert it into a speech therapy building to assist um children. [1:28:32, 1:28:52]: Children and and adults with um speech related issues. The site again is um only point nine six three acres. And in terms of improvements, we're gonna leave the building as is. Um the only real improvements we would need to make would be to put the parking area um in the front um of the building. [1:28:52, 1:29:12]: There are some landscaping and other things that will probably occur here in the rear, and that necessitated because of the change in our zoning category, that we are in need of the variances that have been mentioned and will be addressed in the next application. [1:29:12, 1:29:32]: But those variances really are just about the buffer requirements between O and I and RR property. But as you can see, in light of the fact that the adjacent properties are non-residentially used properties, there's really no need for the buffer in between. [1:29:32, 1:29:37]: Um so the site will basically stay as is with the exception of the parking that'll be in front. Thank you. [1:29:40, 1:29:45]: I'm sure if you wanna any questions maybe uh you finished you wanna [1:29:46, 1:29:49]: They imagine what is the purpose of reducing the size? [1:29:51, 1:29:56]: Um for the variances? Or y you said I'm not sure what I didn't hear the question, I'm sorry. [1:29:58, 1:29:59]: Oh, to put the parking lot in the front. [1:30:06, 1:30:09]: No, um I believe we're gonna keep the property. [1:30:09, 1:30:13]: The building as is, but we've got the real estate broker here. [1:30:14, 1:30:34]: Good evening, uh board chair. Robert Payne. I'm representing CKC Commercial Properties. Uh I do a lot of their real estate for them. I've also got the operator of the business here with me. They can answer any questions that you might have. Uh there will be no additions done to the building. The building suits the the footprint suits the need. Um it's gonna be a small facility, not a lot of kids at [1:30:34, 1:30:44]: one time. Uh I think my conversation with the operator was that on average maybe eight children at a time. Uh at the most it could see fourteen or fifteen at one time, but on average eight. [1:30:48, 1:30:49]: Thank you for that. [1:30:50, 1:31:01]: And I think you said that this would be complementary to the ad the ad uh school that's adjacent or nearby in the vet. I guess they have children with uh They may have auditory issues. Correct. All right. Okay. [1:31:05, 1:31:11]: Okay. Uh do we have any one opp supporting or opposing this project? [1:31:12, 1:31:16]: Anyone wanna speak on behalf in opposition or in support of the project? [1:31:20, 1:31:35]: Hearing none, uh I asked the board for motion. Were you able to find motion? They are second. Second second who's seconded? I didn't I didn't do it very much. Doom is first. Doom is okay. [1:31:37, 1:31:53]: Um Mr. Plashon has moved to uh made a motion. Uh Mr Uh Doom is seconded. All those in favor let it be known by the sign of aye. Aye. Those opposed on here. They ayes have it. The application is uh approved for recommendation. [1:31:54, 1:31:55]: Okay. [1:31:59, 1:32:11]: The fourth case is uh rezoning case number RZ twenty twenty two oh three. Stock break plan commission will hold a public hearing on Thursday, August twenty-fifth, twenty twenty-two at six thirty. [1:32:12, 1:32:28]: Stockbridge City Council will hold a public hearing on Monday, September the twelfth, twenty twenty-two, at six o'clock p.m. in Stockbridge City Hall, 4640, North Henry Boulevard, Georgia, in consideration for a request to change in zoning from RR residential to OR office institutional. [1:32:29, 1:32:38]: Uh zero point nine six four acres at thirty eight eighty four Walt Stevens Road Land Lot twenty five, Section twelve, comprising parcel number [1:32:39, 1:32:42]: O three one oh two oh one two thousand. [1:32:46, 1:33:06]: It's the same case. Is it true? Oh, I'm sorry. I'm sorry. I'm sorry. That's okay. That's yours. Yeah, that's your own. I'm sorry. If you don't inject safely, it won't it won't be. We're on the fifth case. We're on the fifth case. All right, the fifth case, variance uh case I'm a VR 2022 oh two. [1:33:06, 1:33:26]: Stockbridge Planning Commission will hold a public hearing on Thursday, August 25th, 2022, at 6 30 p.m. And Stockbridge City Council will hold a public hearing on Monday, September the 12th, 2022, at 6 o'clock p.m. in Stockbridge City Hall, 4640 North Henry Boulevard, Georgia, to consider a request for one, a variance to reduce the required minimum lots with [1:33:26, 1:33:31]: of one t a hundred and twenty five feet to ninety six point three seven feet and two [1:33:31, 1:33:35]: A variance to reduce the buffer on the eastern side from fifty feet to zero feet. [1:33:36, 1:33:41]: And three are variants to reduce the buffer on the western side of the property from fifty feet to zero feet. [1:33:42, 1:33:43]: Фо [1:33:43, 1:33:48]: Nine point six point zero point nine six four acres at thirty eight eighty four Wall Stevens Road. [1:33:49, 1:33:54]: And landlock twenty five district twelve comprising parcel zero three one zero two zero. [1:33:56, 1:34:14]: One two zero zero zero applicant by application by CK Commercial Properties LLC. Uh CARE of Battle Law PC entry parties may appear at the public hearing. Will the staff present the uh item please? Okay. There you go. All right. [1:34:30, 1:34:32]: Uh really important. Yeah. [1:34:42, 1:34:44]: STF1 must have [1:34:50, 1:34:55]: Chairman, if you'll bear with us for just a moment. I'm sorry, I got it. I got it now. [1:34:55, 1:35:15]: Sorry about that. No problem. When you don't eject it uh safely it sometimes it leaves the stuff from the old disc in there. All right, once again the applicant's requesting three variances from the development regulation, the unified co development code. You want to reduce the required minimum lot width from 125 feet to 96.37 feet, reduce the buffer from the eastern [1:35:15, 1:35:35]: Side from 50 feet to zero feet. Reduce the buffer on the western side of the property from 50 feet to zero. This variance request is run concurrently with the rezoning that we recently heard. The Planning Commission and City Council shall consider the weight and merits of each of the following factors before granting a variance. There are five factors. [1:35:35, 1:35:55]: That you guys must consider before granting a variance. A variance must be granted where owning to special conditions. A literal enforcement of the provision of the unified development code will result in an individual case resulting in unnecessary hardship. A variance shall observe the spirit of the unified development code, secure public safety and welfare, and deliver substantial. [1:35:55, 1:36:15]: Substantial justice. The existence of a non-conforming use on adjacent property or nearby property shall not constitute a justification for granting a variance. The Planning Commission shall make recommendations to the Mayor and City Council, which shall have the authority to render the decision on the variance, pursuant to the public notice and hearing requirements set forth in chapter 9. [1:36:15, 1:36:35]: A variance may not be granted for a use specifically prohibited by the UDC. A variance is intended to compensate for a shortfall in dimensions of a property that will prevent the property from complying with the site design standards. There are extraordinary and exceptional circumstances pertaining to the subject property due to the size. [1:36:35, 1:36:39]: that are not found on other properties in the same zoning district. [1:36:44, 1:36:47]: The front section of the property is a hundred feet in the rear of the of the [1:36:49, 1:37:09]: Of the property. As a result, the subject property is very narrow, which would not meet the minimum lot requirements of the UDC. The reduction of the buffers would allow any necessary development of the subject property. A literal interpretation of the provision of the unified development code would deprive the applicants of the rights comingly enjoyed by [1:37:09, 1:37:29]: By owners of other properties located in the same zoning district. Since the building is not 125 feet wide as required by the development standards of the OI, the applicant may not use it for any other purpose besides institutional purposes. By reducing the minimum live feet from 125 to 96 feet, the applicant could use. [1:37:29, 1:37:49]: Utilize the existing building for institutional purposes. Granting a variance requested will not confer upon the property owner any special privileges that are denied to owners of other properties in the same zoning district. The requested variances will be consistent with the purpose and intent of the Unified Development Code and will be compatible with uses on neighboring properties and will serve the process of the process of the process [1:37:49, 1:38:09]: The public welfare. By approving the requested variances, the subject property will be used to assist children who need speech therapy assistance. The extraordinary circumstances are not a result of the actions of the applicant. The building was developed as a church and a Masonic lodge with a narrow front section. The variants requested are the minimal release that would allow the legal [1:38:09, 1:38:29]: use of the land, building, or structure. The proposed rezoning to the pro proposed rezoning to OI will allow the owner to use the subject property for speech therapy as a speech therapist facility. Therefore the variance is not a request to permit a use of land, buildings, or structures that is, structures that is prohibited in the same zoning district. [1:38:29, 1:38:33]: Staff recommends approval of the three variances. [1:38:45, 1:39:05]: Yes, it would it would it would uh facilitate the the conversion of the building into a speech therapist facility because the change to OI requires them to have a certain amount of parking and they want to reconfigure the the the subject property to put the parking in front and that what and and that's the major thing that our trip [1:39:05, 1:39:06]: Trigger the variance request. [1:39:17, 1:39:18]: You did say yes, sir. [1:39:21, 1:39:39]: Yes, sir. And uh they're putting additional buffering around the building because of the requirements of OI and with a incompatible or different zoning district, which would be the R R next to it, they have to have a certain amount of buffering. So that also plays a factor in in why they need a variance. [1:39:44, 1:40:04]: Can I say something real quick, Mr. Chairman? The only thing I wanted to say that we're going to do any different than what they're they're saying, you'll see it inside of the site plan. Uh county staff asked for us to provide some level of privacy for the encroaching cemetery that's coming from the Red Oak United Methodist Church. [1:40:04, 1:40:11]: found in the purchase process that the cemetery that dates back into the late 1800s encroaches onto the subject property. [1:40:11, 1:40:12]: Um [1:40:13, 1:40:21]: We tried to speak with the adjoining church that actually that's their cemetery to see if they might want that land and we'll do a little bit of a swap, but it didn't really work out. So [1:40:21, 1:40:29]: We're gonna maintain ownership of that cemetery, but we're gonna provide some level of privacy for the loved ones that might come and visit. [1:40:30, 1:40:32]: So you'll see on the site plan um [1:40:33, 1:40:43]: some level of greenery that's gonna kinda round around the cemetery to provide some level of privacy from the subject facility to the cemetery. That's the only other change that we're gonna do the exterior. [1:40:45, 1:40:45]: [6053.8, 6054.6]: Prima. [1:40:56, 1:41:05]: I don't know if we can make our the rest of the presentation there, but um I think we've got our PowerPoint here. [1:41:11, 1:41:22]: So I I wanted to be able to point out um what was just uh stated, although the site plan unfortunately I can't seem let me see if I can [1:41:23, 1:41:28]: Let's try and oops. Make it a little bigger. [1:41:31, 1:41:51]: Alright, so um this is the area where we're talking about the um the wall and the landscaping to give the privacy here. Um understand that with regards to the variances, in order for us to put um the parking lot in the front um and even to rezone the property um as proposed, the site does not meet the [1:41:51, 1:42:11]: Frontage requirement under the O and I district regulation. So allowing us to reduce the frontage from 125 to the 96 allows us to be technically in compliance and not have a non-conformity with regards to the width of the lot. Additionally, um, we want the building itself. [1:42:11, 1:42:31]: To be conforming and by allowing us to reduce the buffer, we're not reducing the setback. We're just talking about the buffer along the side of each side of the property. And so that again allows us to maintain the building where it is as well as to install. [1:42:31, 1:42:40]: All the fencing as proposed and the additional landscaping that's there. If you look at what is currently [1:42:40, 1:43:00]: On the property you can see here, you can almost see the cemetery that was discussed over here. Um on uh to the I guess on your screen to the left side um where the um the signage is for the brokerage signage is there's the cemetery on that side. So we're gonna provide some privacy along um that portion. [1:43:00, 1:43:19]: And then the parking lot area will be in the front. And you can see from our slide here that the parking lot would go technically into the buffer areas on the side. So that was one of the large reasons why we were asking for the reduction in the buffer as well. [1:43:22, 1:43:36]: Right, we're not abutting. And so if the churches were also zone O and I, which would be the appropriate zoning for them versus what they are now, because those churches actually don't have a use permit, um, because they were built prior to that requirement. So [1:43:38, 1:43:44]: Nothing residential. So we don't need buffers against something that's non residential, even though it's zoned residentially. [1:44:04, 1:44:05]: Okay. [1:44:08, 1:44:12]: Hearing none, um take a vote from the board may have a most [1:44:14, 1:44:17]: Mr. Chairman, I move that we approve the variance. [1:44:18, 1:44:30]: Second. Second. Second. Oh is that Mr. Tibodore or uh okay. Uh it's been moved by Mr. Dumas and second by uh Mr. Tibod. [1:44:30, 1:44:33]: Uh for approval all over the paper let it be known by the sign of [1:44:35, 1:44:36]: Balls. [1:44:37, 1:44:42]: I tell it, the application is proof of signaled. [1:44:47, 1:44:50]: But um and this is very complex. [1:44:52, 1:44:55]: Uh this is kind of a long agenda so we're gonna take a five [1:45:00, 1:45:03]: Um as in uh P fifteen. [1:45:04, 1:45:16]: Make sure your jump drive work. I did uh snatch down. Oh, okay. She ain't ejected. Yeah. So make sure you get your work. [1:45:21, 1:45:31]: I don't worry about that. I was uh that's why I said that video earlier. Yeah, yeah well that I had something. [1:45:39, 1:45:40]: Well. [1:45:49, 1:45:50]: Okay. [1:46:00, 1:46:00]: Okay. [1:49:35, 1:49:35]: Oh I see. [1:49:38, 1:49:39]: Oh yeah. [1:49:42, 1:49:43]: C15. [1:49:46, 1:49:48]: Now you put things with reconvene. [1:50:04, 1:50:17]: I think we left off at at at at six, we now start in six. Correct? Yes sir. Okay. Yes sir. Yes sir. All right, we on this is case, this is the sixth case comprehensive plan amendment, case number CP. [1:50:17, 1:50:25]: 2022 03. Stock Ridge Planning Commission will hold a public hearing on Thursday, August 25th, 2022, 6:30 p.m. [1:50:26, 1:50:33]: Stockbridge City Council will hold a public hearing on Monday, September the 12th at 6 p.m. Stockbridge City Hall located at 4640. [1:50:34, 1:50:35]: Henry Boulevard. [1:50:35, 1:50:41]: Stockbridge, Georgia, to consider request for an amendment to the city of Stockbridge's comprehensive future plan use plan. [1:50:42, 1:50:48]: from low density vertical mixed use to high density residential to allow for a mixed use residential development. [1:50:49, 1:50:55]: Application by Highway one hundred thirty eight's Five E Road Land Assemblage L L C [1:50:55, 1:50:57]: Represented by Randy Stamy. [1:50:58, 1:51:02]: The agent the property contains twenty six point five plus or minus acres within. [1:51:02, 1:51:09]: twelve parcels in landlot forty two of District twelve, as are listed below within the Stockbridge city limits. [1:51:10, 1:51:13]: Interested parties may attend the public hearing. [1:51:13, 1:51:29]: Staff, will you present the item? Okay. The property has furniture on Highway 138 West, Lake Spyway Parkway, Spyway Road, Berkeley Drive, Star Circle, and Tributary Parkway. It contains approximately twenty-six point five total acres. [1:51:30, 1:51:50]: With twelve parcels located in landlock 42 of District 12. The applicant has also applied for a rezoning and a recombination application, which which will be heard after this case. Proposed the proposed mixed use development will include 318 apartments and 50 townhomes with a proposed [1:51:50, 1:52:10]: Density rate of 13.8 units per acre acre, which falls well within the high density residential land use designation they are seeking. The high density residential land use category has a range of 6 to 16 units per acre. Currently, the subject property is vacant. The surrounding land uses to the north is to [1:52:10, 1:52:14]: The Glen Devon subdivision off Glendavon Road County. [1:52:18, 1:52:19]: And a vacant [1:52:20, 1:52:40]: Shopping center, Spobby Cummings at 1175 Highway 138. West of the property is Vacant Land. South of the property is Spobby Ridge Subdivision off Spoby Ridge Circle. East of the property is Bailey's Estate Subdivision off Spoby Glen Drive and Spoby Glen Subdivision off Spoby Glen Drive in the county. [1:52:40, 1:53:00]: County. If you look at the screen, you will see the vicinity map, which will put the site, will put your mind in the site of the location. Currently, the proposed development is not consistent with the comprehensive with the comprehensive future land use designation of low density vertical mixed use. Thus, this is what triggers the need for. [1:53:00, 1:53:20]: For the comprehensive plan. The existing designation calls for low-rise building with commercial uses on the ground floor and residential uses on the upper floors. Whereas the applicant is proposing to build a purely residential development with apartments and townhomes and commercial. The applicant has requested a comprehensive plan amendment. [1:53:20, 1:53:35]: to change the proper land use designation to high density, which would allow for the proposed development. The applicant does not wish to develop the types of types of uses the low density vertical mixed use future land use designation calls for. [1:53:36, 1:53:45]: To allow for the proposed development, the applicant has therefore requested a rezoning of of twelve parcels. The PU district [1:53:45, 1:53:49]: is allowed under the high density residential. [1:53:52, 1:53:52]: Their development [1:53:54, 1:54:11]: Oh, I I mix up. Although development, the proposed high density residential land use destination for the subject property is reasonable due to the properties furniture on highway one thirty eight, which is the state highway, where higher densities are appropriate. Due to the subject's properties furniture on highway one thirty eight, [1:54:12, 1:54:32]: It is unlikely that the property will be developed with the types of uses which are called for by the existing low-density vertical mixed-use land use designation. Staff has demonstrated that the requested comprehensive plan amendment is necessary and desirable for the subject property in concert with the requested rezoning of property to allow for a proposed. [1:54:32, 1:54:49]: mixed use residential development. As a result, planning and staff recommends approval of CP 2022-03. Also uh here's a map of all 12 parcels that we this is how we look at this combined. [1:55:04, 1:55:12]: Once again, here's the vicinity map um showing you the approximate location of the subject properties and its relationship with one with highway one hundred-eight. [1:55:15, 1:55:22]: So are there any questions on the company? Uh well your staff recommends it, correct? Yes, staff recommends approval. All right. Yes. Applicant present. [1:55:23, 1:55:25]: Yes, sir. The applicant's a pr is present, yes sir. [1:55:38, 1:55:41]: Good evening. I'm Zach Murray. [1:55:41, 1:55:46]: Thirty Macon Street, McDonald, Georgia. Uh I am the applicant. [1:55:46, 1:55:53]: Did prepare a presentation. Uh if you have any questions you would like to ask me first, I'm open to it while I get the presentation ready. [1:55:56, 1:56:05]: So I didn't get your name again. So that was yes. What's my last name? Murray. Murray? Murray. Okay. Thank you. So I ha I could take that off now. [1:56:13, 1:56:17]: Uh just to give a little history, uh the property is Spivey Commons. [1:56:18, 1:56:21]: It's sat there for a while, completely empty. [1:56:21, 1:56:27]: The land that we actually are seeking to develop right now is a dumping ground. [1:56:28, 1:56:30]: As a Henry County resident [1:56:31, 1:56:41]: Um I really wanted to take some time and be intentional about building something that is of a different standard that I feel our community deserves. [1:56:41, 1:56:56]: Uh because I am a resident here and it's not just about going to buy something to sell it. This is a property that we are going to build and hold and maintain and manage uh as the management company as well. [1:57:00, 1:57:01]: Um [1:57:01, 1:57:21]: So I'll show you a digital presentation. Uh we had several meetings with residents and I wanted their feedback. Based off of their feedback, they did want to see what it would look and feel like. Uh I did go ahead and take the investment of time and effort to actually do a 3D rendering. [1:57:21, 1:57:23]: Of what that would look like. [1:57:25, 1:57:28]: You have a pres oh okay, can we present now, all right. [1:57:36, 1:57:56]: Quick question, how did the residents respond to your presentation or your offer? I had a a a a mixed response. Um you know, some are really concerned uh about the multifamily. Um a lot of them would like to see the commercial, which we have addressed every [1:57:56, 1:58:04]: Commercial space that we have here is actually leased out. Um, and we are bringing the first [1:58:04, 1:58:07]: healthy grocery and nourish and bloom. [1:58:07, 1:58:11]: А ту мекдана на олія за гелті грошей. [1:58:11, 1:58:20]: It is the only smart health of grocery that we have. Um this would be the only one inside of our whole region. [1:58:28, 1:58:30]: Are you proposing that for this site? [1:58:30, 1:58:31]: Uh yes, sir. [1:58:32, 1:58:43]: This this and this entire presentation is we did drone footage and designed over the actual footage. It is a exact representation of what would be there. [1:58:55, 1:59:02]: This is a view of the uh multifamily, which currently the roads are in, the infrastructure is in there now. [1:59:02, 1:59:10]: Uh there is a bridge that is currently there that will allow us to have the multi-family luxury flats in the back. [1:59:11, 1:59:12]: Um [1:59:12, 1:59:24]: completely away from the rest of the development. We do have connectivity. We will do trails that go throughout the property and are connecting to the other trails in the area. [1:59:25, 1:59:29]: Are these individual uh units for purchase or rent? [1:59:30, 1:59:35]: Uh the townhomes are for purchase. Uh the apartments are for rent. [1:59:35, 1:59:37]: What's the price point for the town homes? [1:59:38, 1:59:39]: Uh mid threes. [1:59:39, 1:59:41]: What about the Ronaldo units? [1:59:41, 1:59:53]: I'm sorry. The rental units? Uh the rental units, we're only doing one and two bedrooms. Uh they'll start around 774 square feet. Um the starting price will be around 1500 for that. [1:59:54, 1:59:55]: Uh [1:59:55, 1:59:59]: In in conjunction to what is the market is demanding right now. [2:00:08, 2:00:28]: Um I do want to show you uh Nourish and Bloom will actually take on a bigger space. Uh they have one location now that is in Trilleth down in Fettville. Uh this will be a larger larger grocery footprint. So we did put together a presentation to show [2:00:28, 2:00:36]: Exactly how that process would work and what additional benefits they would be able to serve this community and this property. [2:00:38, 2:00:49]: Um the way this technology works, just to be redundant and explain, you walk in the store, you pick up what you need, uh the smart application automatically [2:00:49, 2:00:57]: With all the cameras and wait, see what you have, and you simply walk out without having to check out, it automatically charges you. [2:00:57, 2:00:58]: Wirelessly. [2:01:00, 2:01:13]: Uh they also have a bistro that will be there that would include the sushi and a juice bar um and also service uh different menus. They also have a climate control robot. [2:01:13, 2:01:22]: That will be able to geotrack this community and be able to deliver to the residents through that climate control robot. [2:01:29, 2:01:31]: Look like you're cutting out the employment opportunities. [2:01:35, 2:01:40]: Uh we still need to stock. There's still an increase. [2:01:40, 2:01:56]: There is uh also the other uh portions of the current existing space have all been leased. Uh there is a smoothie shop that is currently open there. Uh there's a sports bar that is coming there as well. [2:01:59, 2:02:04]: Um there's a accounting firm that will be also take place there. [2:02:05, 2:02:06]: Um [2:02:06, 2:02:26]: And how we arrived at Nourish and Bloom, so you know, I actually waited to my community meetings to see what they wanted in their community. So uh we initially held some units back uh based off of their feedback of wanting something similar to a Whole Foods or a Trader Joe's or something. [2:02:26, 2:02:28]: Yeah. [2:02:28, 2:02:35]: I'd scoured the earth to find what I could find and put whatever efforts we could in order to provide that that feedback. [2:02:37, 2:02:57]: So this is now the actual offerings. There's also a brunch restaurant that will be taking place there as well. There's also a cabana bar and grill that will be taking place. The pool that you saw within that that demonstration is actually a public pool to where you can rent a cabana as well as enjoy food. [2:02:57, 2:03:01]: a as a cabana grow uh right now. [2:03:01, 2:03:07]: So the residents had some input in what um um commercial activity you would have here. [2:03:07, 2:03:09]: We tried to do that as much as possible, absolutely. [2:03:17, 2:03:18]: Any questions from the board? [2:03:18, 2:03:22]: Yes. I'm looking at your site map and [2:03:23, 2:03:28]: I need you to identify where on the map will this commercial component be located. [2:03:29, 2:03:36]: Uh, it's in the current existing commercial place as well as I'll pull up the site map right now. [2:03:37, 2:03:49]: So the this current gray area is curr is where Spivy Commons is now. That's the current existing. This is the cabano bar and grill that would be uh right across from that. [2:03:50, 2:04:04]: Uh the the uh nourish and bloom will be toward this end of it. This is uh where the smoothie shop is with a drive-thru. This is the sports bar and grill, and this is the brunch restaurant. [2:04:05, 2:04:06]: Yeah. [2:04:06, 2:04:10]: So you own that vacant commercial building already? [2:04:10, 2:04:13]: Uh yeah, they are part of this development. Absolutely. Yes. [2:04:15, 2:04:35]: Uh the the pink section that you see there would be the townhomes. As you can see, that they do have an egress going towards Spivy. Our main entrance will be this tributary boulevard parkway. Uh just to mention, just because we want it to be as efficient and easy. [2:04:35, 2:04:55]: Regress and direction as possible to where I am waiting on this landowner for this out parcel. Outside of having that, I can't do uh additional entrance. I have four entrance and exits now. I wanted to add an additional from 138, uh, but until that [2:04:54, 2:05:00]: That landowner responds I I kinda at my max of what I can do. [2:05:02, 2:05:05]: So this project is going forward, whether you acquire that land or not. [2:05:06, 2:05:09]: Uh yes, sir. Okay. [2:05:12, 2:05:13]: Any other questions? [2:05:15, 2:05:23]: Yeah. Can you identify some other projects that you've done that we could take a look at? Uh sure. Similar to this. [2:05:26, 2:05:31]: I don't mean tonight, uh you don't have to pull'em up, but just Oh, okay. Yes, yes. I I can do that. Yeah, absolutely. [2:05:41, 2:05:42]: You have any questions? [2:05:43, 2:05:44]: Been answered. [2:05:47, 2:05:48]: I'm waiting on an answer. [2:05:49, 2:05:53]: Oh uh fifty three y for the additional projects? [2:05:53, 2:05:56]: Some other properties that you've developed in the past. [2:05:56, 2:06:14]: Yes. Uh in Oakwood, Georgia, it's fifty three West. If you go to fifty three West APT, uh but if you go to TELUS Partners, uh it's a full website of all the uh projects and products that we've had. [2:06:14, 2:06:16]: Okay. Thank you. [2:06:17, 2:06:17]: Absolutely. [2:06:23, 2:06:25]: Any questions from the public? [2:06:25, 2:06:27]: Supporting or opposing the project. [2:06:28, 2:06:29]: Yeah. [2:06:29, 2:06:34]: So Chairman, are you gonna go ahead and and open it up for public hearing for those opposed? [2:06:34, 2:06:39]: Yeah, okay. And then we'll close it and we'll do the ones that are in favor. All right. [2:06:40, 2:06:41]: Yeah, yeah. [2:06:42, 2:06:45]: Not the rights. So middle methods. [2:06:47, 2:06:50]: Okay. I am [2:06:51, 2:07:02]: You know, as a resident here name and address please. I'm sorry, Dion Roberts, um Lake Spivy Country Club. I live right there on Spivy Road. Um [2:07:02, 2:07:08]: where the proposed project is being um looked into. [2:07:09, 2:07:16]: Um, you know, I'm just really disappointed. Um I'm disappointed in um my commissioners and [2:07:17, 2:07:21]: Um you know, you guys that we vote for. [2:07:21, 2:07:38]: You cannot bring up anybody else. You cannot attack anybody else. Oh no, I'm just saying this I'm not attacking. Okay, well I'm just saying we well we have to keep this too. I think in the beginning I explained to you that we're not talking about anybody else that's not here, we're not talking about any public office or anything. Right. We're simply addressing the project. Right. Uh okay. [2:07:41, 2:07:47]: There was just three hundred apartments and hundred and two town homes that were just approved across the street. [2:07:47, 2:07:53]: And then now they're proposing three hundred and eighteen apartments and what fifty townhomes right there, that intersection. [2:07:53, 2:08:00]: There is no way. As a homeowner, I am so concerned, not only for the [2:08:00, 2:08:10]: the th that everything is being put right there are these apartments and being put right there all at once, but I'm concerned about crime, more crime, the in um the con [2:08:10, 2:08:11]: The the the [2:08:12, 2:08:16]: Traffic, exactly the traffic. I mean it's just it's just ridiculous. [2:08:16, 2:08:25]: And you know, and I he said that he spoke to the residents. I don't know what residents he spoke to that approved, because everybody that I know that live in the area, nobody approves of it. [2:08:26, 2:08:46]: You know, this is our community, this is where we live. You know, we live in a nice, peaceful community, we love our community. And for these developers to come in our community and they show you a pretty picture, you know, and of course it's gonna be nice and it's gonna be beautiful because they're trying to sell it to you. This is what people, when they're trying to sell you something, they make it look nice and they put icing on the cake. [2:08:46, 2:09:06]: But the fact for being this isn't it just k you know, I'm asking you guys to just please consider not approving this because it's just too much right there at that intersection. That particular particular lot is just too much going right there at at one time. Maybe something else that, you know, benefit the community. But putting more apartments, we really need more apartments. [2:09:06, 2:09:19]: departments right there. You know, the impact on the school system is gonna be horrible. The school system is already overcrowded. You know, it's it's and to p and I have children and I'm concerned for my children's safety. [2:09:20, 2:09:28]: So I'm just asking you guys just to please, you know, take in consideration that that's just too much going right there, right there at that little intersection. [2:09:28, 2:09:48]: I mean, they could probably be single family homes is fine. But to bring all these apartments, they don't care. They don't live in our community. He said he lives. Where do you live? I I don't bel I don't know. They don't live in our community. They come into the community and they put all these apartments and they go back to their nice little uh uh uh homes where the [2:09:48, 2:09:58]: There's no apartments there. So I'm just asking you guys to just to please take that into consideration. It's just too much right there at that little intersection. It's already the traffic is already a hot mess. [2:09:58, 2:10:01]: So I'm just asking you guys not to approve this. Thank you. [2:10:11, 2:10:12]: Anyone else? [2:10:14, 2:10:16]: Anyone else in opposition? [2:10:20, 2:10:21]: Are you in opposition? Yes, sir. [2:10:22, 2:10:30]: Good evening, uh Chairman and Board. Um, long time resident, been here my whole life. Uh forty years I've been here at that Lakes Bobby area, okay? [2:10:31, 2:10:35]: Um listen, the pictures, the videos are beautiful. They really are. I'll give it to them. [2:10:35, 2:10:37]: It's looks like what you'd see in Peachtree City. [2:10:38, 2:10:45]: But I want you to go back to when Spivey Commons was presented to us. It looked just like that. Spivey Commons has been vacant for over a decade. [2:10:46, 2:10:59]: Okay. I love the idea of that development. It the idea of that commercial'cause I live there. Okay. And I what I will tell you you'll you'll remember from the previous uh uh application, I'm a realtor. I do twenty plus million dollars a year in that area. [2:11:00, 2:11:05]: I know what goes on there. I know what people will do, what they want, what they what they don't want. I can tell you. [2:11:05, 2:11:08]: More apartments is not it, guys. [2:11:09, 2:11:15]: You know that has been in fr what has been brought in front of you over the last six months. There's been more that has gone from low re low [2:11:15, 2:11:16]: Residential. [2:11:16, 2:11:20]: Лоденси резиденція та аргаденси резиденція нітін. [2:11:21, 2:11:28]: Right now in the city of Stockbridge or in mailing uh the mailing address of Stockbridge, you've got over sixteen apartment complexes. [2:11:29, 2:11:49]: Peace City has six. We're being told that we need these apartment complexes to get us the retail that we need. Peace Tree City has six. Peace Tree City's density is a thousand people per square mile. We have nineteen hundred plus per square mile in Stockbridge. It has nothing to do with density. This has everything to do with the bottom dot. [2:11:48, 2:11:49]: [7910.0, 7913.0]: All right, I represent people that do this day in and day out. [2:11:53, 2:12:05]: They want apartments because they make more per acre. That's it. The average developer holds on to these things for three to five years at the most. Now, this gentleman may hold on to it longer. I'm not gonna make any accusations. [2:12:06, 2:12:09]: The problem isn't the first owner, it's the second and third. [2:12:10, 2:12:14]: They do not live by what they promise. Not the first one, but the second and the third. [2:12:15, 2:12:24]: Furthermore, do we really believe that this commercial is gonna come through, given that that commercial space has been sitting there for over a decade empty? [2:12:25, 2:12:28]: It's been a crime haven. You go by there at night. [2:12:28, 2:12:33]: There's people hanging out in the parking lot. There's vandal vandalizations happening left and right. [2:12:34, 2:12:44]: Furthermore, I want to make note of a couple other little things. She just referenced four hundred and fifty are being built across the street right now. Now you're gonna add another four hundred. [2:12:45, 2:12:52]: Furthermore, it was not referenced that this abuts Spivey Road. The major ingress egress will be Spivy Road. [2:12:53, 2:12:56]: Because the major traffic is coming from the interstate. [2:12:56, 2:13:03]: It has to turn on the spivy road. If they want to turn in and off of one thirty eight, they have to pass Spivey Commons and turn around and come back. [2:13:04, 2:13:11]: So all this traffic will either be turned on Spotify Road, which is a two lane residential, with no drainage and no sewage. [2:13:13, 2:13:13]: Furthermore [2:13:14, 2:13:24]: Um you've got well I I talked about the forty thousand square feet that's empty. You've got an adjoining three residential neighborhoods that are half acre or larger lots. [2:13:24, 2:13:29]: The National Association of Realtors has released a study that says [2:13:29, 2:13:42]: Apartment communities and high rental communities negatively affect adjoining neighborhoods of single family detached structures with half acre or estate sized lots by fifteen to twenty percent negative. [2:13:43, 2:13:47]: Are you prepared to look at these constituents of yours and tell them I'm sorry [2:13:48, 2:13:56]: You just lost upwards of$60,000 in home value. The average home value in those adjoining communities is$350,000. [2:13:58, 2:14:03]: That said, the only thing that negatively affects that any larger is a strip club. You need to know that. [2:14:03, 2:14:10]: Lastly, I will tell you this, I'll leave it at this. Time is up, time is up. You need to know he told the community Shaq was helping him do this and it's a lie. [2:14:27, 2:14:47]: Good evening. Um my neighbors have already pretty much hit on um the uh areas that I wanted to hit on. Um I'm concerned about all of this rezoning. If it's zoned for commercial, it should stay commercial. Um I I I don't know and like she said [2:14:47, 2:15:06]: There's already town homes and apartments that are being put up on that lot of on that lot of land by Kohl's N one thirty eight package store. Excuse me, could we have your name and address? Oh, I'm sorry. My name is Lisa McFall. I live in the Spybey Glenn subdivision on Creekstone Drive. I apologize. [2:15:08, 2:15:23]: Um so um with that being said, you have traffic on 138. I don't know if you're aware that there are apartments going up alongside Mount Zion Road down by Lowe's and a lot of them. You have a logistics building going up [2:15:23, 2:15:28]: um by the Ford Dealership. Now this is a two lane highway. [2:15:28, 2:15:35]: A two lane highway from I believe that's Mount Mount Zion Boulevard all the way to one thirty eight. [2:15:35, 2:15:37]: that traffic will be impacted by. [2:15:38, 2:15:40]: Now you want to put apartments over here [2:15:40, 2:15:45]: Акросфром Спайві Глен, вич ви ар он Спайві Род. [2:15:46, 2:15:48]: And that will be disastrous. [2:15:49, 2:15:57]: People in Spivey Glenn will not in Spivey Glenn subdivision will not be able to get out of out of our subdivisions. There should not be any more apartments being put up. [2:15:58, 2:15:59]: It's just too much. [2:16:00, 2:16:20]: Now uh um with these ones going up on um on that plot of land by by coals, a four-way stops a four-way stop light is not gonna do anything for traffic on 138. Not a doggone thing. You're gonna also affect traffic on Mount Park on Mount Zion Parkway where where the brand smart is and [2:16:20, 2:16:21]: And the coals. [2:16:22, 2:16:26]: All of that, that's affected. Spear Road will be affected. That's a two lane highway. [2:16:26, 2:16:29]: Скулс а гна би афед, аз де сид. [2:16:31, 2:16:34]: Now you already have three buildings sitting vacant. [2:16:35, 2:16:38]: For years that have been that's partially complete. You have a hotel. [2:16:38, 2:16:41]: Right, that hasn't that just been sitting there for what, three years. [2:16:42, 2:16:43]: Unfinished. [2:16:43, 2:16:45]: next to a a liquor store. [2:16:45, 2:16:49]: So you already know what kind of clientele that's gonna break. That was a that was a terrible [2:16:50, 2:16:53]: Um idea. You have a building next to Wendy's. [2:16:54, 2:17:01]: And then you have a building next to Coles, which the grass is almost as tall as the building is, yet it just sits there unused for no reason. [2:17:01, 2:17:09]: But you want to bring apartments in. What is that going to do to our our our our property value, our property taxes, if it affects it at all? [2:17:12, 2:17:13]: Also [2:17:16, 2:17:22]: Uh let's see. The om I think I mentioned the overcrowding of the school system to traffic. [2:17:22, 2:17:25]: Um all these luxury apartments. [2:17:25, 2:17:36]: All develop all undeveloped land does not need to be built upon or extended, especially if it's gonna disrupt the if it's going to disrupt our quiet community. Thank you. [2:17:41, 2:17:42]: Okay. [2:17:42, 2:17:58]: Chairman chairman. Chairman, you have the um the option to if the if the um planning commission chooses to you have the option to offer additional time to those who still want to speak. That's per vote by the planning commission. [2:18:00, 2:18:01]: Good here. [2:18:01, 2:18:03]: [8285.0, 8291.1]: Go ahead. How many how much time would you like to allot, Chairman? Give'em five minutes. Five minutes. [2:18:27, 2:18:29]: Name and address, please. [2:18:29, 2:18:39]: Sherry Bivens, 8173 Masters Court, Jonesboro, of course. I live in Lake Spotify Club. Um [2:18:42, 2:18:43]: Pretty pictures. [2:18:43, 2:18:45]: Um they're very pretty. [2:18:46, 2:18:47]: What he showed. [2:18:47, 2:18:49]: And we've talked we [2:18:50, 2:18:51]: We've talked about [2:18:52, 2:18:54]: the traffic that [2:18:55, 2:18:55]: The [2:18:56, 2:18:58]: additional apartments and townhomes will bring. [2:19:00, 2:19:04]: We haven't even talked about the traffic that comes in for all the commercial space. [2:19:05, 2:19:06]: The the market [2:19:06, 2:19:11]: En and all the other the restaurants and so we haven't even talked about that traffic. [2:19:12, 2:19:23]: And you're talking about on a two-lane, every road that intersects there that is affected is two lanes. No one has said anything about infrastructure. [2:19:23, 2:19:27]: No one has said anything about scuols. [2:19:27, 2:19:30]: That is I mean this this is major. [2:19:31, 2:19:38]: This is going to affect our property values in such a negative way. I too am a realtor. [2:19:39, 2:19:51]: And everything that uh the gentleman there said is exactly right. The negative impact on residential um um subs the subdivision bringing in that type of um um high density. [2:19:51, 2:19:56]: um h um buildings, uh homes or apartments or whatever. [2:19:56, 2:20:01]: I'm gonna tell you, I am not naive to think that um [2:20:02, 2:20:03]: Ca growth? [2:20:04, 2:20:08]: is not going to happen. It should, it will. But the proper growth [2:20:08, 2:20:18]: Proper growth is welcomed. You know, I'm actually jealous of the of the um um the the prop the the project that's going on on on forty two. [2:20:18, 2:20:23]: The fifty five and older community, I'm jealous of that. I wish that's what was going on that property. [2:20:24, 2:20:31]: I know something has to go there. We all know something has to go there. That's growth. That's that's progress. [2:20:31, 2:20:33]: But proper growth. [2:20:34, 2:20:40]: And that is just not proper growth. I don't care how you look at it, it is not proper growth. [2:20:41, 2:20:42]: So I'm asking [2:20:42, 2:20:45]: I'm pleading, please don't do that to us. [2:20:46, 2:20:48]: We paid a lot of money for our homes. [2:20:49, 2:21:00]: And we we we and we we've we've enjoyed the luxury of where we live, the the the the how close it is to the interstate and all of that, but you're gonna get a lot of flight. [2:21:01, 2:21:04]: And it's going to affect the tax base. [2:21:04, 2:21:12]: Because the people who live in that community pay a lot of money to live in that community, not just for their homes, but in taxes. [2:21:13, 2:21:25]: So think about what it's gonna do to the tax base as well. And one other thing, I understand this is Henry County, but you know who's affected the most? Clayton County, because it is right at our door. [2:21:38, 2:21:51]: Good evening, Council. My name is Dave Murphy, 2877 Mandy Court, Lake Spivey, Georgia, Clayton County. I'm a longtime resident, uh moved in this area in 1996. [2:21:51, 2:21:55]: And just as everybody's already said, we have a good thing going. [2:21:56, 2:21:57]: It's a good area. [2:21:57, 2:21:59]: But we're starting to see it slip slip away. [2:22:00, 2:22:06]: Uh the best western has been vacated now for a while. Spive the commons, of course, we have a one tenant. [2:22:06, 2:22:10]: As you already know, that has been there and he's probably struggling right now. [2:22:11, 2:22:15]: Um a few inconsistencies with the applicant that we already know. [2:22:15, 2:22:21]: When I first met, uh heard this presentation, there was no business card that was given to us. [2:22:21, 2:22:34]: So I had to ask the gentleman what was what his name was, and uh he mentioned a celebrity that we know now is false. So from that point on, everything that you say past that, uh I can't even believe anything you're saying. [2:22:35, 2:22:40]: uh having saying you can build a townhouse for three hundred thousand that's that's that's false [2:22:40, 2:22:41]: Okay, so [2:22:42, 2:22:48]: Again, inconsistencies and statements that you can clearly Google and see. You can look up a lot of things that are being said. [2:22:49, 2:22:50]: Um [2:22:50, 2:22:54]: Right now we're trying to hold on what little bit of Clayton County that is livable. [2:22:54, 2:22:56]: And that is the Lake Spive area. [2:22:56, 2:23:03]: And if anybody was trying to build anything, you would think they would take the Lake Spoby name, that brand, and build upon that. [2:23:03, 2:23:19]: Because we have uh with the Lake Spivey Parkway, I was involved in that. I was involved with everything that is that you know about Lake Spivey right now. There's a whole uh consortium of neighborhoods. And uh the uh HOA president, you got Nikki Ford still over there if he's still hanging on. [2:23:20, 2:23:21]: But um [2:23:21, 2:23:28]: Again, we're trying to keep this area and we all still send tax dollars to s a stock bridge. All right. [2:23:29, 2:23:30]: That's all. Thank you. [2:23:38, 2:23:45]: Chairman, there needs to be a vote to allow for uh any more additional time to be given for this portion of the public hearing. [2:23:47, 2:23:49]: I have a motion to extend the time. [2:23:53, 2:23:55]: Make a motion extended time for a public hearing. [2:23:56, 2:23:56]: Oh second. [2:23:57, 2:24:05]: Been moved and seconded. All those in favor, let it be known by the sign of aye. Aye. Aye. All those opposed, ayes having. Time is great. [2:24:06, 2:24:13]: My name is Loretta Clark. Step a little closer, I can't hear you. Step a little closer. My name is Loretta Clark. Oh, Roma. [2:24:14, 2:24:21]: Loretta Clark. I live at 124 Spike Ridge Circle and I've been there since they developed the um subdivision. [2:24:22, 2:24:30]: The only thing I have to say, I haven't heard about a meeting, but that butts right up to the back of my house. I want to know how that's gonna affect me. [2:24:30, 2:24:32]: Tell me that. Absolutely. [2:24:42, 2:25:02]: President, may I speak to him for one moment? I I'll answer it first and I'll let him speak. There will be uh the UDC w will calls for a certain amount of buffering. There will be uh plenty of buffering in between her residential uses and the and uh his development. So there will be a lot of landscaping and uh vegetation planted within the buffer. So she [2:25:02, 2:25:05]: Probably wouldn't even be able to see the the development. [2:25:05, 2:25:14]: Right. Uh to to echo that. All right, we would need to close the public hearing in order to um take comments from the applicant at this time. Okay. [2:25:15, 2:25:19]: Anyone else in support or opposition of the application? [2:25:21, 2:25:25]: And fill out parts, I think. Fill out parts. [2:25:31, 2:25:37]: How many additional minutes did we go? Five. Five minutes. Max for all parties. [2:25:42, 2:25:48]: It's got as an Israel quick and speaking block and uh [2:25:49, 2:25:50]: Yeah, I think. [2:25:50, 2:25:55]: Anybody anybody in the far? Yeah. [2:26:29, 2:26:49]: Okay, I'm uh Nikki Ford. I live at 205 Reeves Creek Way in Jonesboro, Henry County. Um I'm the president of Spivy Land Subdivision of HOA there, and uh also on the Lake Spivy Community Board. So [2:26:49, 2:27:09]: The consensus with most of the people that I've spoken to about this is the apartments. Um the presentation looks really good, but the apartments is still killing everybody. So I just wanted to at least express that on their behalf. [2:27:09, 2:27:21]: um that with the apartments coming across the street, which was a horrible move, that this this was also a concern with most of the neighbors. [2:27:22, 2:27:25]: Um other than that, the presentation looks real good now. [2:27:26, 2:27:29]: Okay. Thank you. Yeah. Thanks. [2:27:36, 2:27:45]: Hello fellows, ladies. My name is Roger Wilson. I live at 118th Spider Ridge Circle. [2:27:45, 2:27:52]: in uh the spy ridge subdivision. This property is directly behind my house. [2:27:52, 2:27:58]: There's a small creek that runs behind my house between the property [2:27:59, 2:28:00]: That was mentioned. [2:28:01, 2:28:02]: And when it rains [2:28:03, 2:28:04]: That creek fields up. [2:28:05, 2:28:08]: From just uh residents that's in that area. [2:28:08, 2:28:09]: Yeah. [2:28:10, 2:28:13]: If you build more dwellings in that area. [2:28:13, 2:28:16]: Where the water gonna go? Going to that creek? [2:28:16, 2:28:18]: And they go float my house out. [2:28:19, 2:28:20]: And all the houses. [2:28:20, 2:28:21]: Behind there. [2:28:22, 2:28:23]: So [2:28:24, 2:28:26]: I pray that you'll approve this. [2:28:27, 2:28:30]: I'm a praying man. I'm gonna pray for you that you don't approve it. [2:28:31, 2:28:32]: Thank you, sir. Thank you. [2:28:38, 2:28:41]: This portion of the public hearing is closed. [2:28:42, 2:28:46]: I believe the applicant wants to speak again. I I would. [2:28:47, 2:28:59]: Uh just a few things that that was mentioned. Uh you're you're right. Spivey Commons has set empty for a very long time. [2:29:00, 2:29:08]: And it's not all the leases for that space have been signed. It's not, hey, this is possibly coming. [2:29:09, 2:29:10]: I do have [2:29:10, 2:29:14]: A contingency based off of this development. [2:29:14, 2:29:16]: Ford Nurris and Bloom. [2:29:16, 2:29:25]: As the gentleman said, the smoothie shop may be struggling because although we feel like we have the community to support it, we do need some more density. [2:29:26, 2:29:27]: In order to do [2:29:27, 2:29:40]: As far as the school system is concerned, this is why it is intentional to only have one and two bedroom apartments, which are for professionals at this price point, and for empty nesters. [2:29:42, 2:29:42]: I'm sorry. [2:29:46, 2:29:49]: Miss, miss, miss. Okay. [2:29:51, 2:30:00]: Um I I I want to address my affiliations. I I wouldn't think I would have to do that as a professional. [2:30:00, 2:30:05]: Yes, I am affiliated with Sakil O'Neill. I'm on the Saks Life Show with this project. [2:30:06, 2:30:14]: is being presented by TELUS Partners, who has the experience and the history and the track record of building great products. [2:30:15, 2:30:31]: I I as far as the buffer is concerned, there will be a buffer to where you will not be able to even see the multifamily. In addition with that, the multifamily will be completely gated and fenced in throughout the entire property. [2:30:36, 2:30:42]: It seems that the the residents are concerned about the apartments. You know. They're concerned about [2:30:42, 2:30:49]: I don't think they have any question about the townhouses. Mm-hmm. They're concerned about the apartments, you know. Um [2:30:51, 2:31:02]: You know, I I I see your point of view and I also see their point of view. You know, I mean and and I I think that you need to work out I I think you'd work out a compromise with the community about that. [2:31:03, 2:31:11]: You know, I don't I don't know. I mean, it does you know, one way or the other, I'm just saying I'm hearing from both sides, I'm hearing that you've invested a lot in this property. [2:31:11, 2:31:20]: uh that that you have uh very picturesque plan. This would be a hundred million dollar investment. I I I I understand that, but we also have two realtors here. [2:31:21, 2:31:27]: Who are really opposing it and I think that the real opposition to to your project is coming from the apartments. [2:31:28, 2:31:37]: I as as before looking at this pot of land, for one I did try to solve her problem. I understand the empty hotel across the street. I can't control that. [2:31:38, 2:31:43]: This empty property I could make a difference on that's turned into a dump site. [2:31:43, 2:31:48]: I also understand that this is a four lane highway divided by a concrete median. [2:31:49, 2:31:51]: That is right by the interstate. [2:31:52, 2:32:03]: Where else would I put a density project as such as this besides that property? And I'm trying to do that at the highest quality level as I can to set a new standard in our community. [2:32:04, 2:32:07]: Have you uh talked to the Department of Transportation? [2:32:07, 2:32:09]: [9129.8, 9135.0]: Which is which is why I was trying to take the go ahead, sorry. [2:32:15, 2:32:35]: It w is man it would be mandatory that he consult with G Dot and they would have a say so in in the property. Because it it fronts on the state highway, one thirty eight. It is a state highway and it is state DOT. Yeah. But that was also at why I wanted to look at the additional property because that U turn that does allow [2:32:35, 2:32:37]: That would be a left turn into the property. [2:32:37, 2:32:40]: So all the concerns in meeting [2:32:41, 2:32:47]: With Nikki Ford and all the residents that I have, I have consulted them throughout this entire process. [2:32:48, 2:32:58]: it i it wasn't without consideration of their value and their home values. And if we look at the trends from my real estate, unless my I have a broker who's here as well. [2:32:59, 2:33:00]: Any mixed use facility [2:33:01, 2:33:15]: It actually has done the opposite. It actually has increased their home values. Not just the apartments. This is a part of a full development that has commercial retail parks within it and walk the walking trails with connectivity. [2:33:18, 2:33:24]: Is i am I speaking correctly? Yeah, I mean you're bringing a commercial element, you're bringing it up. Please come to the mic, please. [2:33:36, 2:33:38]: Good evening. Um [2:33:38, 2:33:53]: Name and address. I'm Rob Franks, one twenty one North Main Street, Jonesboro, Georgia. Uh oh, I'm sorry. Okay. Did you get that or No, repeatedly. Okay. I'm Rob Franks, uh one twenty one North Main Street, Jonesboro, Georgia. [2:33:55, 2:34:15]: Time buff already. No, I'm just kidding. I was like, do I need to wait or just add a little levity to this one? All right. Yeah, no, we're actually trying to bring a commercial element back to the Spivey Commons Center for as a for instance. We handle the Spivey Commons Center. The big problem we've had there is that we don't have what the [2:34:15, 2:34:30]: tenants want, which is density right there at them. They're wanting walkability. They're wanting um a an item that we can't provide without having that literally at their back door. So of course it will bring [2:34:30, 2:34:36]: you know, it'll bring nourish and bloom, for instance, or others, it'll bring them into the area which then is [2:34:36, 2:34:42]: you know, attractive for the r rest of the residents. So I don't think it adversely affects the um [2:34:42, 2:34:47]: you know, the residence, I think it actually adds value because you're you have um [2:34:48, 2:34:52]: you know, additional businesses, additional opportunity, you know, located near you. [2:34:55, 2:34:55]: Well. [2:34:59, 2:35:02]: Okay, thank you, sir. All right, no problem. Thank you. [2:35:05, 2:35:20]: Some of the comments that are made are are outside the scope of our analysis. So we want to stick to what's appropriate to our analysis, uh the subjective criteria or the subjective comments that were made, we need to exclude those comments. [2:35:25, 2:35:25]: Okay. [2:35:27, 2:35:29]: Any questions up here? Any questions of the board? [2:35:31, 2:35:32]: Board have any questions? [2:35:32, 2:35:33]: I have a question. [2:35:35, 2:35:49]: What I'd would like to know is w what kind of relationship that you manage to talk to the homeowners about the property that you want to develop and did y'all hash out any type of agreement as far as uh [2:35:49, 2:35:55]: What you were gonna do on the property. I I don't really hear that from you. I I hear a [2:35:56, 2:36:01]: Some folks over here complaining about w what's not gonna benefit them. [2:36:01, 2:36:15]: But I hadn't really heard from you where you were saying what did you really work out with all these people here sitting here that's in opposition? Uh has there been any negotiation or [2:36:15, 2:36:20]: What you should and should not do with the property from these individuals I'm looking at tonight. [2:36:20, 2:36:40]: Uh yes, sir, there was. Uh their main concerns were about the the retail and wanting something to come there. Uh they identified and gave me a list of what they would like to see in order to shape that commercial space. And I changed [2:36:40, 2:36:45]: the landscape of that whole commercial space to actually adopt what they wanted to see there. [2:36:48, 2:36:52]: But that's not what they're saying. [2:36:53, 2:36:54]: Oh yeah. [2:36:55, 2:37:13]: never seen asking Excuse me, excuse me. Chairman, if if you would, anyone who speaks does need to come to the podium if we're gonna open it up for public hearing. Otherwise this is a conversation between the applicant and the planning commission. We would close for for public hearing. Go ahead, finish up. [2:37:13, 2:37:18]: Um I I I did as much as I possibly could. [2:37:19, 2:37:23]: Even before submitting the application, I reached out to these residents. [2:37:24, 2:37:29]: which is more than what most people in a development position would do. [2:37:30, 2:37:50]: i if I'm honest. Um I I did receive a list. Unfortunately if I was not able to contact you, I I apologize. I went through mainly the association leaders of Lake Spivey, uh starting with Susan Butler, Nikki Ford. Um I I I I did take an attempt to do that and make [2:37:49, 2:37:53]: make as many adjustments as I could to give them what they wanted, sir. [2:37:56, 2:37:57]: Okay. [2:38:00, 2:38:17]: Yeah, I I mean we did host a community meeting, um, which is actually where I met Dave Murphy and and uh we did invite all of the community to come give us their input. And I will mention that was prior to even submitting an application at all. [2:38:19, 2:38:19]: All right. [2:38:21, 2:38:22]: Okay. [2:38:28, 2:38:30]: I have a motion on this application. [2:38:32, 2:38:32]: Oh. [2:38:36, 2:38:47]: Mr Chairman Go ahead. I'm not one to be adversarial unnecessarily and I'm not one to rub the stamp either. [2:38:49, 2:39:07]: But I I in my heart I feel that we need to pump the brakes on this one. Pardon me? I feel that we need to pump the brakes a little bit on this development, in view of the fact that we just approved three hundred or store apartments across the street. [2:39:08, 2:39:10]: Oh [2:39:11, 2:39:18]: We talked about annexation of earlier in the in the meeting and when you look at the proposed annexation map. [2:39:18, 2:39:22]: A lot of these folk in this room are gonna be voting [2:39:23, 2:39:24]: Whether to [2:39:25, 2:39:28]: be annexed into the city of Stockbridge in November. [2:39:29, 2:39:30]: Um [2:39:34, 2:39:36]: I just feel kinda like [2:39:38, 2:39:41]: We dumping trash on their yard and then inviting them to a cookout. [2:39:43, 2:39:45]: If if if you [2:39:46, 2:39:47]: Amen. [2:39:49, 2:39:54]: If we want people to be a part of our city, I think we gotta treat them a certain way that [2:39:54, 2:40:06]: they feel respected and and I'm not degrading the project by no means. I mean I understand when you look at the map and the you especially when you overlay the floodplain on the map. [2:40:07, 2:40:09]: The property [2:40:10, 2:40:12]: A large part of it is not developable. [2:40:13, 2:40:16]: Because of the floodplain issue and and so I understand the density [2:40:17, 2:40:19]: that they uh they uh developer is trying to meet. [2:40:20, 2:40:24]: 'Cause he has certain objectives that he has to reach as well. And I understand that. [2:40:25, 2:40:36]: But in light of what we just did, we and I mean the city, what we did across the street, I I I kinda wanna pump the brakes a little bit on this one. [2:40:38, 2:40:39]: Oh [2:40:40, 2:40:48]: Does not mean I'm necessarily t a hundred percent against it. Doesn't mean that I'm necessarily a hundred percent for it, but I just think we need to slow down. [2:40:50, 2:40:53]: All right, what's your motion? I move that we deny it. [2:40:54, 2:41:14]: Um before you you do the motion, let me let me ask a few more questions. Do you mind, Mr. President? Um is is there some way that uh uh you can get with the patrons and renegotiate and look at everything uh with the people in the community? [2:41:14, 2:41:16]: Uh is is that possible? [2:41:18, 2:41:38]: I I think that would be the w the place to be with this project right now because of so much opposition. And uh I agree with Mr. Duma over Mr. Doom is over there. But I'm speaking from a business point of view. I think you need to get with the community, all the community leaders and see what you [2:41:38, 2:41:40]: What you guys can come up with. [2:41:40, 2:41:42]: That's where that development is concerned. [2:41:45, 2:41:49]: Are you seconding his emotion his motion? Yeah, I'm seconding his emotion. [2:41:50, 2:41:50]: Yeah. [2:41:53, 2:42:03]: Uh the motion for the application has been a motion has been to deny the application. It's been moved by Mr. Dumas, second by Mr Thibodeau. [2:42:06, 2:42:08]: All those in favor, let it be known by the signify. [2:42:09, 2:42:10]: Alright. [2:42:10, 2:42:12]: Uh those opposed. [2:42:14, 2:42:17]: Eyes have it, the application is denied. [2:42:18, 2:42:19]: Mr. Chairman. [2:42:20, 2:42:20]: Yeah. [2:42:23, 2:42:28]: Was the denial unanimous? [2:42:29, 2:42:32]: Or did we have any other votes? Yeah, it was unanimous. Okay. [2:42:45, 2:42:48]: Rezoning case is the next one is the seventh case. [2:42:54, 2:42:59]: Resonant case number two. Our meeting is still in session all. [2:43:00, 2:43:02]: You gotta get some order. [2:43:04, 2:43:08]: Tell the people to be quiet. [2:43:14, 2:43:23]: Resulting case 202204, Stockbridge Planning Commission will hold a public hearing on Thursday, August 25th, 2022 at 6:30 p.m. [2:43:24, 2:43:33]: Stockbridge City Council will hold a public hearing on Monday, September the twelfth at six PM in the Stockbridge City Hall, located at forty six forty North Henry Boulevard, Stockbridge, Georgia. [2:43:34, 2:43:40]: to consider a request for a change in zoning for twenty six point five total acres, plus or minus. [2:43:41, 2:43:43]: A rural residential. [2:43:43, 2:43:51]: Suburban residential and C2 General Commercial to PUD Plan Unit Development to allow for a mixed-use residential development. [2:43:51, 2:44:11]: Application by Highway 138 Spivary Road Land Assemblage to LLC, represented by Mr. Randy Stamy, the agent. The property contains twelve parcels of land in lot forty-two, district twelve, as are listed below within the stockbridge city limits. And the parties may attend the public hearing. Staff will [2:44:11, 2:44:12]: I hear your presentation. [2:44:13, 2:44:20]: Yes. If you look on the screen you'll see a map showing the the assemblage of the twelve parcels. [2:44:20, 2:44:23]: Uh the the applicants uh submitted a [2:44:24, 2:44:44]: Concept plan that shows the apartment the proposed apartment complex will be built in the southwest corner of the site with this entrance off Highway 138 West Lake Spive Parkway from Tributary Parkway, which is currently a dead-end street. The apartment leasing center along with the swimming pool will be located directly in front of Lake Spive Parkway. [2:44:44, 2:44:46]: [9887.8, 9907.8]: At the west side of Tributary Parkway. A new bridge will be built across or under Tributary Parkway, just south of the street's intersection with Berkeley Drive. A trash dumpster will be located on the Stubb Street off Tributary Parkway, and a large an enlarged stormwater management will be located beyond that. The proposed townhome community will be built at the [2:45:07, 2:45:27]: Northeast corner of the site with entrances of Berkeley Drive and Star Circle, which both lead to Spyber Road. The apartment complex will feature a leasing office with a miles with a mail center, a maintenance office, a trash center, and 500 parking spaces at a rate of 1.5 spaces per unit. A large dog park will be located to the north. [2:45:27, 2:45:47]: North of the apartment complex, and a military area is shown as part of the townhome community, and a small dog park will be located nearby. The applicant's proposal in its current form is not consistent with the low density vertical mixed use land use designation. The density for the proposed project is 13 units per acre, which places the proposed project [2:45:47, 2:46:07]: In the high-density residential land use category, which allows a density rate between 6 and 16 units. This rezoning proposal was accompanied by the Compran Amendment to change the land use to high density residential that would allow for the proposed development. This project meets one of the main goals and purpose and intent of the city of Stockbury. [2:46:07, 2:46:27]: Grid Unified Development Code, and that is to encourage the most appropriate and best use of land, buildings, and other structures throughout the city. The proposed in its current form meets the purpose and intent of the UDC. Also, the proposed project can serve as a catalyst for future commercial development in the city. The proposed mix [2:46:27, 2:46:47]: Residential development with townhomes and apartments would represent an acceptable land use transition between the existing single-family detached housing to the east and west and the existing retail uses along Highway 138 West and Mount Zion Parkway. The proposed project does not meet the threshold of a regional development review and therefore [2:46:47, 2:47:07]: Or the impacts from the proposed development will be considered acceptable and considered a normal part of daily living in an urbanized area. No trip generation memo has been submitted. However, since the proposed project will be located along the state highway, Georgia DOT and Heron County DOT will be required to be consulted and the [2:47:07, 2:47:23]: the design of the transportation network of the development, including ingress and egress. The developer will consult with officials from those two organizations to determine whether any road improvements or traffic signalization adjustments needs to be made along Highway 138. [2:47:24, 2:47:44]: The proposed development would meet the purposes of the Parkway mixed use overlay district. The project would feature a balanced mixture of residential densities and proposed commercial uses whereby residents can truly live, work, and play. The proposed development can be a panacea for future economic development activity in the target area. The subject properties are [2:47:44, 2:47:53]: As currently zoned, are less likely to be developed than a high-density mixed-use development due to the subject property location on a state highway. [2:47:54, 2:48:14]: Near Reeves Creek tributary and other environments environmental challenges and the lack of a pedestrian access for customers who are seeking neighborhood retail products and service. The subject property in its current form is less likely to be developed. Only a high density development would be feasible at the location because of its challenges associated. [2:48:14, 2:48:18]: associated with the land. A mixed use development with commercial uses will be more realistic. [2:48:21, 2:48:41]: And the proposed rezoning of the subject property to PUD would allow for such action. The rezoning of the subject property to PUD would allow for flexibility in design and greater usage of the total site area than with the current zoning. Staff recommendation. The planning and zoning staff recommends approval with conditions for the proposed rezoning of the [2:48:41, 2:49:00]: subject property from R R Rural Residential, SR suburban residential, and C2 General Commercial to PUD. The following conditions. The project will be developed in conformance with the City of Stockbridge Unified Development Code and all other code sections regulating site development standards and requirements. [2:49:03, 2:49:11]: Approval of CP 2022 to change the property's future land use density from low vertical to high density. [2:49:11, 2:49:25]: The rezoning shall not be finalized until the applicants receive approval for marriage for a recombination plat, and uh no land disturbance permit shall be issued for the subject property until the applicant has had the recombination plat officially recorded. [2:49:28, 2:49:28]: That's it. [2:49:30, 2:49:32]: Have the applicant come forward? [2:49:35, 2:49:35]: Yeah. [2:49:47, 2:49:50]: Uh once again, uh [2:49:52, 2:50:10]: We are looking to do a mixed use. Uh after a a market analysis of what would take to improve that area, we feel like the product that we're presenting it would set a new standard in this in this area uh in its entirety. Um [2:50:15, 2:50:22]: Is there any questions as I put up more of a presentation if you would like to refer back to that? [2:50:23, 2:50:24]: ovo je [2:50:25, 2:50:27]: Split up. [2:50:40, 2:50:45]: Uh once again I I'm it's blank, but uh [2:50:45, 2:50:47]: Again, I live in this community. [2:50:47, 2:50:50]: А мна пропозин анітін. [2:50:50, 2:50:57]: uh that I wouldn't want to live in myself to give you some examples of impact. [2:50:57, 2:51:03]: Of uh PUD such as this has had, we can look at Trilith and Fedville. [2:51:03, 2:51:05]: And look at the surrounding home values of that. [2:51:06, 2:51:13]: They've increased for over six hundred percent. You can check those facts. Uh if you look at Serum B. [2:51:13, 2:51:23]: uh in Palmetto. They've done very similar to the same, very s structure very similar to the same with the type of density that we had, some of them even more. [2:51:23, 2:51:30]: And these are rural places that they have put a PUD that has had a positive impact on that community. [2:51:37, 2:51:57]: Uh the townhome products that we are proposing would uh garnish from the professionals uh appraisals and standards from realtors would garnish that support of the mid-350s at 1,800 square feet, plus looking at what the home owners pay. [2:51:57, 2:52:02]: behind it that would actually increase their home values as far as comps are concerned as well. [2:52:08, 2:52:09]: Okay. [2:52:15, 2:52:17]: And it's [2:52:20, 2:52:21]: All right. Um [2:52:25, 2:52:27]: Any question from the board? [2:52:34, 2:52:36]: Open for c public comment. [2:52:39, 2:52:51]: Ma'am, ma'am, ma'am. Why do I have to fill out another card? [2:52:51, 2:52:52]: Give me a call. [2:52:55, 2:52:58]: Oh no, my partner had this face on this. [2:52:58, 2:53:11]: While she's filling that out, I'll go ahead. I my I already had a card that had this case and the last case on it. He filled it out for me. Robert Payne, uh Lake Sbobby. Um, listen, uh thank you so much for putting the brakes. Thank you for the extended time. [2:53:11, 2:53:16]: Listen, we're all about this positive development. We want to talk to the gentleman. I'm on the Lakes Bobby Board. [2:53:16, 2:53:19]: I was not given an invite to this whatever talk he had. [2:53:20, 2:53:22]: I'm on the Lakes Bobby board, been there for a decade. [2:53:22, 2:53:23]: Okay. [2:53:23, 2:53:26]: Number one. Number two, you cannot build that town home for three hundred thousand dollars. [2:53:27, 2:53:28]: It I I do it every day. [2:53:29, 2:53:35]: Uh the cost to build right now is at a minimum$175 a foot. That would make this three hundred and fifteen thousand dollars to build. [2:53:36, 2:53:45]: He cannot build that and sell it for that price and make any money. He can't do it. Okay. Well so your comment the comments limit to Sorry, please tell me. [2:53:45, 2:53:59]: The case yeah. And not but that it's the townhomes, right? I I understand, but we don't I don't know the price point. I don't know what it costs to to to construct it. So I'm an expert in the industry. Okay, all right. Uh forgive me. I don't if if you don't want me to, I won't talk about it. No, no, I'm just saying w we want to keep it. [2:53:59, 2:54:04]: The month before the board. We're talking about wait a minute, we're talking about the application. [2:54:04, 2:54:16]: Okay. Um the applicant has referenced that um this is increased values at Trilleth by six hundred percent. That is true because it's adjoining to the largest movie studio on the eastern seaboard. [2:54:17, 2:54:21]: This has no movie studio. Furthermore, Trilleth is vast majority. [2:54:21, 2:54:25]: single family homes with a small, small footprint. [2:54:25, 2:54:34]: of apartments. This is a large the application is a large footprint of apartment homes and a small footprint of town homes. It's quite the opposite. [2:54:35, 2:54:36]: Thank you so much. [2:54:37, 2:54:42]: He said he lives here. He does not. He does not live in that community. Uh that's not part of Well, he said it, sir. [2:54:43, 2:54:45]: He said it. All right, okay. All right. [2:54:46, 2:55:00]: Okay, I'm not gonna be long, but I'm gonna he trileth seems like something that he really promotes and he's proud of. Let me tell you, like I said, I'm a realtor. I had a client that moved here from um California just [2:55:00, 2:55:01]: Recently three [2:55:02, 2:55:15]: weeks four three four three four weeks ago and I was in search of a rental property for her in the Peachtree City area. You know how many pro you know how many uh uh properties came up in Trilliph that are for rent now? [2:55:15, 2:55:16]: Five. [2:55:17, 2:55:20]: Five and that's a very small community. [2:55:20, 2:55:23]: So five units for rent. [2:55:24, 2:55:28]: In that size of камін, дас а майже іпакт. [2:55:29, 2:55:30]: So you want to tout [2:55:31, 2:55:31]: Truly. [2:55:32, 2:55:33]: Let's just be [2:55:34, 2:55:37]: T lay all the facts out about what's going on in Trillieth. [2:55:37, 2:55:41]: Yes, it's in Peace Tree City. Yeah, their tax base is higher than ours. [2:55:41, 2:55:51]: But and yeah, and maybe they can support something like this. And maybe theirs would look like this, but I don't see uh that looking like that. Pretty pictures. [2:55:52, 2:55:53]: All right, thank you. [2:55:58, 2:56:04]: Loretta Clark, um I was very upset the last time. I'm not as upset now. [2:56:07, 2:56:10]: I'm thinking about my peace of mind, our peace of mind. [2:56:11, 2:56:13]: When I look out my back door [2:56:13, 2:56:15]: I don't wanna see an apartment building. [2:56:16, 2:56:19]: Way up there, and I don't want'em looking down in my yard. [2:56:20, 2:56:22]: I've been living there too long. [2:56:24, 2:56:29]: And it's a nice quiet neighborhood, even though there's a lot of crime starting in Henry County. [2:56:31, 2:56:35]: But I can see it getting way worse once we put this in there. [2:56:37, 2:56:37]: So [2:56:39, 2:56:40]: Thank you. [2:56:47, 2:56:49]: Um just do I have to say my name again? [2:56:49, 2:56:57]: Yes. My name is Lisa McFall, Min's By B Glenn Subdivision, five oh six Creekstone Drive. Just real quick. [2:57:07, 2:57:08]: The issue was [2:57:08, 2:57:11]: It was presented to us as he was only gonna put [2:57:12, 2:57:13]: Business is there. [2:57:14, 2:57:19]: Towards the end of the meeting is when he snuck in the the apartments in the town homes. [2:57:19, 2:57:21]: And that's when the meeting really got live. [2:57:22, 2:57:41]: So, and he lives in McDonough. He does not live in this community. This community, he may be a part of the overall area, but he does not live in the community where these apartments are going to be built, where these townhomes are going to be put. Across the street from where we have, we have two entrance. We have an egress and an e and uh ingress or entrance and an exit. [2:57:42, 2:57:45]: And where he's putting them will directly affect us. [2:57:46, 2:57:48]: So I just wanted to make that clear. Thank you. [2:57:55, 2:57:56]: Okay. [2:57:59, 2:58:00]: Any questions? [2:58:01, 2:58:03]: Board members, any questions? [3:00:41, 3:00:42]: That's it. [3:00:42, 3:00:43]: Yes, sir. Okay. [3:00:47, 3:00:48]: Any uh [3:00:49, 3:00:52]: Public comment support opposing, I'm sorry. [3:00:52, 3:00:53]: Okay. [3:00:57, 3:00:58]: Again [3:00:58, 3:00:59]: Infrastructure. [3:01:00, 3:01:02]: І снареді скулс. [3:01:03, 3:01:03]: Not ready. [3:01:04, 3:01:05]: That's [3:01:07, 3:01:27]: It's it's nothing. They haven't told us, they haven't put anything before us to say this is what this is what we're going to do to improve, make sure that this improves your community, that it will not have a negative impact on your community, that the traffic will be uh alleve, alleviated by this. [3:01:27, 3:01:32]: This, this is what our plans are, this is what we're putting in place. We don't have any of that. [3:01:32, 3:01:42]: And I am not on my board, but I am very, very much in touch with the people who are on our board. I I knew nothing about a meeting. [3:01:43, 3:01:53]: And I live right there b um across the street almost. I live in Lakes Five Country Club, but their subdivision is across the street. So we're all really one community. [3:01:54, 3:01:58]: I knew nothing about that. I am very in tune what's going on in my community. [3:01:58, 3:02:01]: And I knew nothing about that. All right, thank you. [3:02:06, 3:02:18]: Uh Robert Payne Lakes Bavi, just making a note. He started the clock at five minutes, supposed to be ten minutes, so please don't cut me short. Oh, it's five minutes, but go ahead. It's been ten, all the others, but I'll I'll I'll defer to you, Chairman. Um listen. Um [3:02:19, 3:02:25]: Again, we as the board would love to see this kind of development come to fruition. We don't want the multifamily [3:02:25, 3:02:26]: But [3:02:26, 3:02:33]: Townhomes maybe? Fine. Come to us, talk to us. I would love to support you in getting nourish and bloom and some of these tenants. [3:02:33, 3:02:38]: I'll be your biggest fan,'cause it's gonna help me increase property values on the properties that I sell each and every day. [3:02:38, 3:02:40]: I'm there, but please come talk to me, number one. [3:02:41, 3:02:45]: Number two, as far as the assemblage is concerned, I'm asking for you to deny it. [3:02:45, 3:02:49]: If he if you assemble this property, you're gonna make this an easy property for him to offload now. [3:02:49, 3:02:53]: and uh to another developer that's gonna try and bring this multifamily in. [3:02:53, 3:02:57]: If you keep this separated right now, it's gonna make it a lot harder for him to offload this property. [3:02:58, 3:03:05]: Um I don't even know that all of it's even been purchased just yet, but that I'm not sure of that. But that said, um [3:03:06, 3:03:08]: There was one other thing I was gonna say. [3:03:12, 3:03:14]: Uh I I'll leave it at that. Thank you so much. Thank you. [3:03:19, 3:03:21]: Any questions from the board? [3:03:23, 3:03:25]: Any questions from the board? [3:03:26, 3:03:27]: May I have a motion? [3:03:30, 3:03:32]: Chairman, I move again to deny. [3:03:33, 3:03:34]: One second. [3:03:35, 3:03:42]: Mr. Doomas has made a motion to deny Mr uh [3:03:43, 3:03:55]: Triple Door has second. All those in favor, let it be known by the sign of aye. Aye. Aye. Aye. Those opposed, ayes have it. The recombination application is denied. [3:04:01, 3:04:03]: Think that is the end of our agenda for today. [3:04:04, 3:04:05]: Yeah, project of [3:04:13, 3:04:14]: Project updates. [3:04:17, 3:04:17]: None. [3:04:18, 3:04:20]: Staff uh comments. [3:04:20, 3:04:21]: There are no staff comments. [3:04:22, 3:04:23]: Board comments. [3:04:25, 3:04:27]: May I have a motion to adjourn? [3:04:28, 3:04:29]: Motion to adjourn the meeting. [3:04:30, 3:04:32]: Been moved and seconded. [3:04:33, 3:04:35]: The motion adjourned is carried. [3:04:38, 3:04:39]: Oh. [3:04:52, 3:04:55]: Well thank you. [3:05:04, 3:05:07]: Uh seeing you. [3:05:08, 3:05:12]: Yeah, it's a good one. [3:05:13, 3:05:17]: Okay. [3:05:43, 3:05:46]: No, no, no, no, no, no. That's not the case. That's not the case. [3:05:52, 3:05:53]: I told you. [3:06:15, 3:06:16]: I mean that's good.
