Um listen, I've I got a lot that I'd love to talk about tonight, but I'm gonna keep uh the items on the agenda and I'll speak about those when the agenda items come up. [1:09:54, 1:09:56]: The biggest thing I want to reference to you right now [1:09:56, 1:10:08]: is you guys are getting a lot of amendment requests to change your comprehensive plan as well as your land use plan. A lot. You're getting more than the county gets, you're getting more than any city in this county gets. [1:10:08, 1:10:12]: And there's a varying number of reasons and I won't go into them, I'm not gonna say I know them all. [1:10:13, 1:10:16]: But there's with that uh amendment [1:10:16, 1:10:18]: We're getting a lot of these apartments. [1:10:19, 1:10:21]: And we're going from [1:10:21, 1:10:25]: We're not doing just one step jumps. We're not going from a medium density [1:10:25, 1:10:27]: We're not going from a [1:10:27, 1:10:29]: We're not going from an R three to [1:10:29, 1:10:33]: Medium density, we're going from low density to high density. [1:10:34, 1:10:38]: This is a massive jump. This is something that your land use permit does not. [1:10:38, 1:10:40]: Even consider. [1:10:40, 1:10:42]: Not your land use permit, your land use plan, forgive me. [1:10:43, 1:10:44]: It does not even consider [1:10:44, 1:10:46]: But yet developers keep bringing them to you. [1:10:46, 1:10:48]: For varying reasons, and who knows why. [1:10:49, 1:10:59]: But at the end of the day, if all you continue to get in front of you are high density, you know the per capita income that that's gonna come with that. And we all know that [1:10:59, 1:11:04]: With the retail and the restaurants that all of us are wanting, you guys included. [1:11:05, 1:11:08]: It's not about the density level, it's about the per capita income. [1:11:08, 1:11:10]: If you look at places like Peachtree City, [1:11:11, 1:11:12]: You look at places like Alpharetta. [1:11:12, 1:11:25]: Their density is lower than what you have, yet they have all the shopping that everybody here says they want. It has nothing to do with density. It's about per capita income. If you bring the type of uh buyers here, [1:11:26, 1:11:31]: That come along with the higher per capita per capita income, you will get. [1:11:31, 1:11:34]: what you're looking for as far as your residential is concerned. [1:11:35, 1:11:40]: I'm I'm so overwhelmed. It seems like every month you guys are getting requests. [1:11:41, 1:11:43]: To change your land use plan. [1:11:44, 1:11:51]: I don't know, are you guys getting tired of that? I mean it's like it's like the community has to come in here and speak to you guys every month and it's not necessarily your fault. [1:11:51, 1:11:56]: But at some point you guys need to stand by the plan that you have adopted. [1:11:57, 1:12:00]: You guys have this plan, but you kip changing it. [1:12:00, 1:12:07]: What's the point of the land use plan when a homeowner buys it to say, Yep, this looks like a secure area, my investment's gonna be safe? [1:12:08, 1:12:09]: But yet you change it. [1:12:10, 1:12:17]: It wasn't that long ago that you adopted this uh this plan that's on place right now. I don't remember the exact year, but it wasn't [1:12:17, 1:12:19]: That long ago. [1:12:19, 1:12:21]: So I would just ask for you guys when you're um [1:12:22, 1:12:26]: Looking at these uh cases tonight in front of you, just to consider you're not making a minimal jump. [1:12:27, 1:12:29]: You're making a massive jump in the real estate world. [1:12:30, 1:12:34]: From going from low density to high density. I appreciate your time. Thank you, sir. Appreciate that. [1:12:38, 1:12:40]: There are no further comments. [1:12:40, 1:12:43]: Thank you, Madam Clerk. Stand by one second, please. [1:13:00, 1:13:13]: holding a part of our meeting, several of the proclamations of a reading tonight, as well as square and ceremonies, so that you all will be witness to uh some good things. The site appears to be suitable for the proposed speech. [1:31:59, 1:32:19]: Rezoning with approved variances. Issues regarding buffering, topography, drainage, access, size, and shape of the property will be addressed. Variance requests will be heard after this case right here. The applicant will be seeking approval for three variants. One, a variance to reduce the minimum light width from 125. [1:32:19, 1:32:39]: feet to ninety six point three seven feet, two, a variance to reduce the eastern section of the property from fifty feet to zero. And three, a pending variance to reduce the western section of the property from fifty feet to zero. Staff recommends approval with conditions. And the conditions are that the three variances be approved later on tonight. [1:32:41, 1:32:45]: That's it? Okay. That's it. Council, any questions for Mr. Anderson, please? [1:32:47, 1:32:50]: Questions over May Force. Um [1:32:51, 1:33:02]: I met earlier and we sort of had this discussion. I saw Mrs. Battle um on my way in. Uh Mrs. Battle. [1:33:03, 1:33:05]: Um as you are approaching [1:33:06, 1:33:09]: We had discuss some type of separation. [1:33:10, 1:33:29]: um from the outer exterior of the boundaries of this new facility and the cemetery and you mentioned that the church recommended some type of uh shrubbery. Uh I I guess the question now is it the understanding [1:33:29, 1:33:33]: of the uh new business coming in that they would maintain. [1:33:34, 1:33:36]: Um that shrubbery. [1:33:36, 1:33:49]: That is correct. That they would that they would maintain that that line of shrubbery that would separate the cemetery from the actual uh business itself. [1:33:49, 1:34:09]: Yes, and let me state my name for the record. Michelle Battle with Battle Law, 3562, Habersham at North Lake, Tupper, Georgia, 30084. We did have uh discussions with um Pastor Pendleton. The cemetery actually does belong to the United Methodist Church, and so they are very um comfortable with [1:34:09, 1:34:29]: With the proposed use of the property, but what they said was that they would prefer not to have a fence. They don't want that area fenced in. What they would prefer is that we agree on some shrubberies, and um the applicant, um the owner of the land, uh, has agreed that they will um continue that dialogue with the church. They want to do some uh [1:34:29, 1:34:44]: uh boundary line um uh work on the survey to make sure that they understand where their boundary line is and then they will work cooperatively um to put shrubberies there that will be maintained by um my client. [1:34:44, 1:34:50]: Mayor Ford. Yes ma'am. Have we moved into the applicants portion because I would need to start the clock. [1:34:52, 1:35:12]: Well, I actually d if they I would uh well that's a group. Yeah, that's a question. I I don't actually have anything really to add to the conversation. Um the presentation that staff made I think was very detailed. Um we are simply here to respond to any questions that you all may have. And that's because yeah, she's up there because Mayor Potem has a question, so that's the reason why. Uh the rest seem like the rest of the council and [1:35:12, 1:35:22]: have any questions at this time. Well just to follow up. Go ahead, Speaker. I I just want to make sure that the applicant do understand uh that they would maintain [1:35:23, 1:35:23]: Um [1:35:24, 1:35:32]: the the shrubbery line as far as constantly trimming, mulching, making sure that it stays attractive. [1:35:32, 1:35:38]: Yes. Okay. Mayor one. Thank you, Mayor. No, no problem. Welcome. Any any other comments, uh questions, or concerns from the council? [1:35:41, 1:35:42]: Uh huh. [1:35:45, 1:35:50]: If this is approved, so contractually that would be put in there as a contingency for [1:35:51, 1:35:55]: Well the if this is approved, my assumption is that the [1:35:55, 1:35:59]: Um landscaping requirement would be a part of the condition. [1:36:00, 1:36:20]: which means that it would be, it would run with the land, which means that the owner of the land would be responsible for making sure that that landscaping gets done. Because in order to convert that building now to O and I, they're going to have to come in and get a new building permit and like. So they'll have to be able to show to staff that we have in fact complied with the installation. [1:36:19, 1:36:25]: of um the landscaping in accordance with whatever they agree to with the church. [1:36:28, 1:36:33]: Yes. And then that because and because the shrubberies, remember, they're gonna be on our property. [1:36:34, 1:36:37]: So we have every incentive to maintain them properly. [1:36:38, 1:36:42]: So the shrubberies that we're adding, like any other landscape strip. [1:36:42, 1:36:46]: that will be incumbent upon this landowner to maintain them. [1:36:58, 1:37:03]: It would still be it's still be applicable because it's a part of the zoning conditions. Yes, sir. [1:37:04, 1:37:16]: No matter what happens, as long as it stays zoned O and I, pursuant to those conditions, we have to maintain those shrubs. We can't just put them up today and then come back a few weeks later and take'em down. They are required to be there and maintained. [1:37:17, 1:37:37]: So on that note, one okay, you do have a question. Go ahead, Mr. Azan. Yeah, in addition to that, we discussed uh uh the frontage of the building. There would be uh upgraded landscaping and the correct uh for it to uh be in keeping with planting and shrubbery to uh for the attractiveness of the of the correct and um we can add [1:37:37, 1:37:50]: that as a condition that there be landscaping in the front and that we um work cooperatively with the church to do the landscaping along the perimeter, um along the cemetery. And we will do both of those things. [1:37:50, 1:38:10]: In addition to that, we just want to make sure again we're asking uh as before we go through that each business maintain the right-of-way all the way to uh the pavement, not just including the right-of-way. Is that agreeable? Um I don't know if staff has a picture. I don't want to go too far past you're talking about along our frontage. Right. It's to the it's just to [1:38:10, 1:38:14]: to the pavement. That's what the city code is, it's to the pavement. [1:38:15, 1:38:22]: M Mr uh Mr. Anderson, Ryan? And could you uh pull up the she's looking for a a picture? Yeah. Could you pull that up please? [1:38:25, 1:38:29]: We certainly are gonna do anything that is along our frontage, no question. [1:38:29, 1:38:39]: Right, that's to the road basically is what you're doing. You're mowing the lawn. It shouldn't be the grass cut here and then right at the grass uncut. I got you. No, I hear I understand what you're saying. Yes. [1:38:40, 1:38:43]: Okay, thank you. We're gonna be maintaining all that area. Thank you. [1:38:44, 1:38:46]: Once again, any other questions for the council? [1:38:46, 1:39:02]: Now i b uh time for you, you've already he made a presentation, so you're good with the presentation, nothing different that needs to be done. His presentation is fine. Um we're just here um to answer any questions that you may have. I think staff has done a great job of explaining what the project is, and we're here to answer any further questions that you may have. [1:39:03, 1:39:04]: Okay. [1:39:04, 1:39:24]: On that note, there's no other questions. This is a public hearing. So I'm gonna open up the public hearing and then allow the audience or individuals to speak on this note. And uh we'll start with my on my left, which is way over here on the right side, four four. Any anybody wants to speak for or positively in reference to this particular [1:39:24, 1:39:32]: Particular project that's been brought before us over here in the very my very left side. Four. [1:39:33, 1:39:35]: Middle. Four. [1:39:36, 1:39:50]: My far right side, four. Okay, not seeing no, not hearing anybody. All right, so we'll go over here for anything against from my far left side. Um from this section over here, any have any comments against this actually being approved if if it's approved? [1:39:50, 1:39:51]: What's it? [1:39:51, 1:40:08]: Yes, sir. I still practicing the customary ten for and ten against. That's what we practicing. Well well we'll s we'll see how things work. We'll we'll see. We'll see. We'll see. Okay, this um okay, no one else against it this project and R and the far left. Anything in the middle? [1:40:08, 1:40:21]: And far end. Okay. So on that no comments one whatsoever. So I'll close the open hearing on that particular item. And on that note, uh council, is there a motion to approve this uh rezoning? Yes, ma'am. [1:40:27, 1:40:27]: Number nine. [1:40:30, 1:40:40]: Case R Z two twenty twenty two dash three in consideration of a request of change in zoning from R R residential to OI office institutional [1:40:41, 1:40:44]: Okay, sir, second. Uh excuse me, sir. [1:40:54, 1:40:54]: Second. [1:40:55, 1:41:15]: Okay, motion has been made in the second. Any further discussion? All flavor, please indicate the unamounced decision. Thank you very much. All right, next what's next is variance case RV 2022-02. Consideration to request for one A variance to reduce the required minimum lot width of 125 feet to 96.5. [1:41:15, 1:41:35]: Two, a variance to reduce the buffer on the eastern side from 50 feet to zero feet, and three, a variance to reduce the buffer on the western side of the property from 50 feet to zero feet for 0.964 acres at 3884 Walt Stevens Road in landlock. [1:41:34, 1:41:52]: twenty five of District twelve comprising parcel a number zero three one dash zero two zero one two zero zero zero application by CKC Commercial Properties L C CO Battle Law PC presented by once again by Mr. Ryan Anderson sir please [1:41:53, 1:42:02]: Okay, good evening. There's um attached on the screen is a is a um a aerial photo of of the subject property. [1:42:03, 1:42:13]: Um there are extraordinary and exceptional circumstances pertaining to the pertaining to the size of the subject property that are not found on the other properties in the same zoning district. [1:42:17, 1:42:37]: The front section of the property is 100 feet in the rear of the property. As a result, the property is very, very narrow, which would not meet the minimum lot requirements of the unified development code. The reduction of the buffers would allow any necessary development of the property. A literal interpretation of the provision of the unified development code. [1:42:37, 1:42:57]: Would deprive the applicants of the rights commonly enjoyed by owners of other properties located in the same zoning district. Since the subject, since the building is not 125 feet wide as required by development standards of the OI zone, the applicant may not use it for institutional purposes by reducing the minimum lock width from [1:42:57, 1:43:17]: From 125 feet to 96.37 feet, the applicant could utilize the existing building for institutional purposes. Granting a variance will not confer upon the property owner any special privileges that are denied to other owners of property in the same zoning district. The requested variances will be consistent with [1:43:17, 1:43:37]: The purposes and intent of the Unified Development Code and will be compatible with uses on neighboring properties and will serve the public welfare. By approving the requested variances, the subject property will be used to assist children who need special therapy assistance. The extraordinary circumstances are not the result. [1:43:36, 1:43:56]: of the actions of the applicant. The building was developed as a church and a Masonic lodge with a narrow front section. The requested variances are the minimum relief that would allow the legal use of the land, building or structures. The proposed rezoning to OI would allow the owner to use the subject property for the speech therapy facility. [1:43:56, 1:44:07]: Therefore, the variance is not a request to permit a use of land, buildings, or structures that is prohibited in the same zoning district. Staff recommend approval of three variants. [1:44:10, 1:44:11]: So [1:44:14, 1:44:30]: Does anything else you need to show us on this sir at all? That's it, sir. Okay, all right. Council, any yes sir. Mr. Blanc, go ahead, please. Um are we looking at this map as the church facing north? Or we look at the eastern section to be, is that would that be on the then would be on the right side? Yes sir on this map? [1:44:32, 1:44:36]: Then if we reduce it buffet we took uh fifty feet to zero. [1:44:38, 1:44:45]: That's that is the coming a parking. They're they're putting the parking lot in the front of the building. So they're reducing it to put the parking lot in the front. [1:44:46, 1:44:47]: You don't have to point it. [1:44:48, 1:44:57]: Yes. Uh I can use this. There's a better photo in the um in the presentation that the in the applicants uh package that we didn't have. Um [1:45:14, 1:45:20]: Where's the zero feet? Is that on the east side of the building, closer to the cemetery, or are you talking about in the front of the building? [1:45:23, 1:45:28]: Very decent. [1:45:33, 1:45:35]: What was the name of your presentation, Michelle? [1:45:41, 1:46:01]: My concern is taking the buffer to zero on that side, which the eastern side goes toward the church. Sir. If I could, I think um the issue is, I think you pointed out in the Zoom, Miss Battle, that the church had actually encroached upon the property on the on the east side. Is that what the issue is? [1:46:01, 1:46:06]: boundary. They will actually have p has some graves on the site of the actual building itself. [1:46:07, 1:46:15]: So I think that um the main thing is to distinguish between um the setback and the buffer. [1:46:16, 1:46:35]: So right now the zoning ordinance requires us to install a 50-foot buffer over and above the setback requirement. And the way that the buffer works is that we would be able to do no work within that buffer on either side. [1:46:36, 1:46:56]: The buffer is in place only because the properties next door are still zoned residentially. But the truth of the matter is, neither one of those properties are used in a residential context. They're all zone, they're used for a church, but they're zoned like it's a house. [1:46:56, 1:47:13]: So part of what we feel is that we shouldn't be held to that buffer requirement because we are not adjacent. The purpose of it is to protect you from single family detached homes. We're not a single family detached home. So there's really no reason to have the buffer there. We have the setback. [1:47:13, 1:47:20]: And the problem with the buffer is on the front of the property where we're gonna be putting in um [1:47:21, 1:47:31]: the the driveway and the um parking area, the buffer would obscure our ability to do that because we would have to have a buffer all the way across the front. [1:47:32, 1:47:48]: And our building currently sets within the buffer because the build the remember the property isn't that wide. So if you've got a fifty foot buffer, literally it overlaps. The property's only like ninety-four feet wide. That's why we're asking for a variance. So if you got a buffer fifty feet [1:47:49, 1:48:03]: to the center and fifty feet to the other s on the other side, that means they overlap. There's literally no buildable envelope available on the property. So what we're asking is to remove that buffer requirement, because it's not necessary on either side. [1:48:03, 1:48:13]: the landscaping, you all have already approved that we are required to do that landscaping um along the one side, particularly adjacent to the um the cemetery. [1:48:13, 1:48:33]: And by removing um the the buffer, we also can do the parking area. I think you can see this on the screen up here now. Um the parking area here, um, in order to put the parking lot in, we can't have the buffer. Because remember again, this property is 94 feet across, and the buffer [1:48:33, 1:48:35]: [6516.1, 6518.9]: And the eastern side is fifty feet. [1:48:39, 1:48:41]: So they that's the whole property. [1:48:43, 1:48:53]: Does that make sense? Understand. I I understand, Miss Battle. Well let me ask you a question. If you remove the if you take the buffer and remove it to zero, then what uh what is the setback you're gonna have in place? [1:48:53, 1:49:08]: Um I believe the setback, I want to say the setback here, if I can enlarge this. Uh hold on, let me put it to the slideshow. See if uh puts it up here. [1:49:08, 1:49:21]: Okay, good deal. All right, and let's do this. This is a normal setback. Yeah, seventy five. I think the setback is ten feet on either side. Is ten feet? Um I believe so. It's ten feet. [1:49:23, 1:49:23]: Can't see that. [1:49:25, 1:49:32]: See the ten or fifteen feet on each side. I can't see the little writing there, but we're not in we meet the the setback. [1:49:35, 1:49:36]: What do you say? [1:49:36, 1:49:56]: Site plan is in the presentation. Yeah, this is the site plan. I'm looking at it right here. Um, we're not encroaching over the setback requirement. As you can see on the plan up here, we're showing where the setback is. So we're not actually at 10 feet. Yeah, what I believe that the setback right there is 10 feet, and we're at that 10 feet. Whatever it is, we're not encroaching. [1:49:56, 1:49:57]: approaching over it. [1:49:58, 1:50:06]: So we didn't have to ask for a setback variance. We only had to ask for the removal of So the setback on each side would still be ten feet without the without the fifty foot business. Yes. Correct. [1:50:07, 1:50:27]: So we're not impacting the setback. Remember, there's a distinction between the setback and the buffer. The buffer is there to have an un typically an undisturbed area with trees and the like that's buffering a residential community from a non-residential use. Well, that's not our circumstance. We've got non-residential on all three sides. [1:50:27, 1:50:28]: [6630.3, 6630.8]: Okay. [1:50:31, 1:50:33]: No questions at all, Council. [1:50:36, 1:50:56]: Ms. Battle, did you have anything else for a presentation? Has this covered it with Mr. Ryan's covered everything? Um I well, let me give my name and information again. 3562, Haversham at North Lake, uh Tucker, Georgia, 30084, Michelle Battle with Battle Law representing the applicant. Um we appreciate the approval of the rezoning. Um [1:50:56, 1:51:16]: The variances again are needed because we have an abnormally shaped lot. The frontage of the lot, which is smashed between the church and the additional property on the other side. This was subdivided out by the church because at one point it was all owned under one parcel. [1:51:16, 1:51:36]: Uh for whatever the reason is, when they subdivided that out, um the frontage was only 94 feet of frontage. And so we are asking to reduce the frontage requirement from the hundred feet that is required to um the frontage that we actually have. So we're not asking for more than what's already there, and that without doing that. [1:51:37, 1:51:41]: Um it would leave our lot as a non conforming lot. [1:51:42, 1:52:02]: Additionally, we asked for the removal of the two buffers on either side, mainly because one, we don't need the buffers as already explained. Secondly, we are going to do the landscaping as shown on the site plan and as just approved by City Council that we are required to have. [1:52:02, 1:52:22]: Landscaping along the side where the cemetery is located. So we will be providing that. In the front, we're going to be doing a parking lot. Again, in order to actually install the parking lot, we cannot have those buffers as well because that would cover all of the 100% of the area where. [1:52:22, 1:52:42]: the um parking is going to be placed. So the only improvements that you're going to see on this property are the ones that you see on the site plan. And we're fine with that being site plan specific. So we will have the building itself. We're not looking to do any enlargement of the building. We will be inhabiting [1:52:42, 1:52:50]: The building as is, and then we would simply be putting the parking lot in front with the landscaping along the side and in the front. [1:52:52, 1:52:55]: Okay. Any questions for uh Miss Battle at all? Anybody? [1:52:56, 1:53:16]: Okay. And thank you. Miss Ryan, anything else? Okay, thank you very much. All right, ladies and gentlemen, this is uh part of the uh public hearing. So I'd like to open the public hearing uh for this. So full so I'll start the course on my left, this right side over here. Anybody for and comments for this particular project on my right side. [1:53:16, 1:53:19]: I'm excited on my left side. In the middle. [1:53:21, 1:53:32]: Over here on the right side. My right side. Okay? Nothing for. Anybody any comments against any comments against this particular project? In my left, far left. In the middle? [1:53:34, 1:53:42]: Right. Seeing none, so I'll now close the public hearing. On that note, Council, is there a motion to approve this uh variance change or not? [1:53:43, 1:53:44]: So move. [1:53:44, 1:53:50]: Mr. Blount says so moved. Is there a second? Second. All right, Mr Alexander, second down. Any further discussion? [1:53:52, 1:53:58]: All in favor, please indicate. She announced the season. Thank you very much. Appreciate it. Thank you. [1:54:02, 1:54:22]: And we'll move on. Comprehensive plan amendment case CP 2022-03. [1:58:00, 1:58:15]: All right. Before I begin, I'd like for everyone to take a look at the screen. That's the vicinity map. It it'll tell you exactly where uh the proposed development is slated to take place. Um the proposed mix [1:58:16, 1:58:36]: Mixed residential project including 318 apartments and 50 townhomes with a proposed density rate of 13.8 units per acre, which fall well within the high density residential land use designation for which the applicant is seeking. The high density residential land use category has a range of six to sixteen units per acre. [1:58:35, 1:58:38]: Apparently the subject property includes twelve parcels. [1:58:45, 1:58:50]: Here's a um a aerial photo which includes all twelve parcels of the land on the screen. [1:58:57, 1:59:00]: The slide that we have up now is a zoning. [1:59:00, 1:59:15]: This is a copy of the zoning map. Um the current use of the land is vacant. The surrounding zoning to the north includes the Glen Devon subdivision off Glen Devon Road. It's vacant. Um [1:59:16, 1:59:36]: And you have the Tranquil Trails Development, three shopping centers at Spivey Cummings at 1175, Highway 138. West of the property, you have vacant land. South, you have Spivey Ridge Subdivision, off Spivey Ridge Circle and Cindy County. East of the property, you have Bailey's Estate Subdivision, off Spivey Glen. [1:59:36, 1:59:56]: Which is in the city, and Spivig Land subdivision off Spivigland Drive, which is in the county. Currently, the proposed development is not consistent with the comprehensive land use designation of low-density vertical mixed use for the subject property. [1:59:56, 2:00:16]: On the upper floors, whereas the applicant is proposing to build a purely residential development with apartments and townhomes. The applicant has requested a comprehensive plan amendment to change the property's land use designation to high density residential will allow for the proposed residential densities. The applicant does not wish to develop the types of [2:00:16, 2:00:21]: uses which the low density vertical mixed use future land use designation called for. [2:00:25, 2:00:34]: The proposed high-density land use designation for the subject property is reasonable due to the property's frontage on Highway 138. [2:00:45, 2:00:58]: Due to the subject property, property's frontage on Highway 38, which is a state highway, it is unlikely that the property will be developed with the types of uses which are called for by the existing low density vertical mixed use designation. [2:00:59, 2:01:04]: Staff has staff recommends approval of the comprehensive plan amendment. [2:01:08, 2:01:11]: And on the screen is a copy of the um future land use map. [2:01:16, 2:01:20]: Is that it, sir for now? Okay, council. Any questions for Mr. Ryan? Yes. Go right here, please. [2:01:21, 2:01:41]: Uh Ryan, thank you for that excellent presentation. I certainly appreciate that. I think um in our last zoning hearing what we discussed was the city's definition of high density was far uh less than what other surrounding jurisdictions were deeming. [2:01:40, 2:01:59]: high density. And it was the desire of the staff to cutter at some point to mesh us up with what the surrounding jurisdictions were deeming to be uh high density, because really and truly, if it was surrounding jurisdiction had this particular designation, it might not be designated as high density. Is that correct? [2:01:59, 2:02:00]: Yes, sir, that is correct. [2:02:00, 2:02:20]: Okay, so at some point staff did want to endeavor to correct that. So basically it's out of balance with the surrounding jurisdictions. Is that correct? Yes, due to the changing conditions at the city of Stockbridge is as it has underwent growth, as the population has expanded, the current um six to sixteen units per acre uh [2:02:20, 2:02:27]: Uh high density residential category really is for a suburban type community. Stockbridge is becoming more and more urbanized. [2:02:28, 2:02:48]: Okay, all right, absolutely. So in terms of uh the things that are are going on, it is uh the staff recommendation for this was was was for approval, is that correct? Yes, sir. Okay, and based on that uh recommendation you had look at what the surroundings look like, what the future [2:02:48, 2:03:08]: call for. And your sp in your opinion, you've stated to us clearly that what is defined as now is a very low likelihood of that ever occurring. Is that correct? Yes, sir. Okay. All right. And um in terms of uh things, I just in terms of what's going on here, y'all I I want [2:03:08, 2:03:28]: Wanna address the audience and understanding what's going on here? Please understand that what goes on here is that our hands are tied. Every last one of you all are gonna come to the podium and you're gonna tell us about traffic and you're gonna tell us about the stand by, stand by. [2:03:28, 2:03:48]: Okay, but what what are the specific questions we have for Mr. Mr. Ryan? I'm gonna I'm gonna get to that point. If you just give me give me about 60 more seconds, I'm gonna get to that point. If you give me 60 seconds. In terms of where we're trying to go, we bit the schools submitted a letter, the surrounding jury we we uh offered obviously there's gonna be some improvements that are in closing. [2:03:48, 2:04:01]: with the highway parkway corridor, correct? Yes, sir. Mm-hmm. Okay, those that it mandates that and also because the uh the the development is fronting on the state highway, uh G Dot and uh [2:04:01, 2:04:07]: And uh Henry County uh Department of Transportation will have some say so in overall transportation design. [2:04:07, 2:04:09]: Can I have Miss Carter come to the podium, please? [2:04:12, 2:04:20]: Hi, Miss Carter. Uh by the way, Ryan, is anybody any other attorneys or besides you and and maybe Miss Carter here need to pr present for us before we open up for uh public hearing? [2:04:21, 2:04:28]: Uh Mr Gardner, will you come to the podium? Excuse me? The applicant is here but no other tarnatives. Okay. Okay. Thank you. [2:04:30, 2:04:50]: Boy, Miss Carter. I have a I have a c I have a question for them. Uh in terms of over the last year, we have been jointly meeting with Clayton County, Henry County, and the city of Stockbridge working on a community improvement district for that. Ms. Carter, I believe you are part of that board. Uh one of those endeavors was for us to [2:04:50, 2:05:06]: complete feasibility studies for improvements that were needed along Highway 138 and submit a request uh along with Clayton and Henry County for additional funding. Uh by con we contacted Congressman Scott's office uh to assist us with that. Are you aware of that? [2:05:06, 2:05:14]: That's correct. The we have a consultant that's working with all three jurisdictions to make sure we have a fluid and uh collaborative plan. [2:05:15, 2:05:35]: Okay. That the timing as we had connect called and connected with uh Congressman Scott's office was the Biden infrastructure bill was available and they had advised us that we needed to do feasibility studies in order to grab uh that money and to be uh have our projects be shovel ready when the money was being dispersed. Is that correct? [2:05:35, 2:05:41]: That's correct. And that is part of this location along with several others throughout Clayton and Henry counties. [2:05:41, 2:06:00]: So basically what has d been determined is that there's a need for improvement to Highway 138. We would need to submit these feasibility studies to assist uh Congressman Scott's office in assisting us. We're garnering the millions of dollars or the trillion dollars, some of that trillion dollars that is available through [2:06:00, 2:06:02]: the Biden infrastructure bill, is that correct? [2:06:02, 2:06:22]: Correct. And also the um joint cities and county for Henry County Transportation and Trails Plan calls for that as well. Calls for many improvements. Absolutely. And Mr. Gardner, you're you're very well aware of what we've been doing in terms of meeting. Uh the Clayton County Commissioner, DeMont Davis is on the on the call, you're on the call. [2:06:22, 2:06:42]: Several others on the call. Carlotta Hurrell, Chairwoman is on it on the call. Sherry Matthews is on the call. In addition, all of us is the first time that we've all been able to sit down collectively and work jointly in pursuing the millions of dollars that are due to this area in order to prove this. Is that correct, Mr. Gardner? Can you talk about your [2:06:42, 2:06:45]: awareness of these meetings over the last year. [2:06:46, 2:06:50]: Well yes, sir, I've been a part of those meetings for the last eight months since I've been on board. [2:06:51, 2:07:11]: Um where the count the two counties are looking at improving the highway one hundred thirty eight uh corridor, um pretty much from Clayton County all the way through and down forty two. Um that's been what we've been working on the last eight months since I've been here. And uh we're looking at going after those funding sources through [2:07:11, 2:07:14]: through the feds uh to make the implementation of it happen. [2:07:15, 2:07:35]: All right. And part of that is a community improvement district being established similar to what you see at Cumberland. Galleria or areas are similar to that. Uh the concept plans that were created created uh ten foot multi-use paths down both sides of Highway 138. Uh the concepts include outside dining. Uh [2:07:35, 2:07:42]: Uh in addition to that um uh beautification is that in in terms of the median and the uh right of ways, is that correct? [2:07:43, 2:07:58]: It is. It is, yes. And you all are continuing to meet uh on a regular basis to bring this to a closure. And I think NickelWorks, the uh who's working on the feasibility study, indicated that it was ready for presentation and would be presented to this council. [2:07:58, 2:08:11]: That's correct. We w have received the study late last week to review and we'll be meeting with them and the other jurisdictions to discuss our comments. And from there we'll be scheduling for nickel works to come out and present to each jurisdiction. [2:08:11, 2:08:31]: Right. And in in your professional opinion, when we're showing and d demonstrating that w new growth is coming to that area, such as this development and the one across the street, that would probably help us in in garnering those funds to show that there is new growth and that uh those funds are being needed as new people move to [2:08:31, 2:08:33]: to the area with your professional pin. [2:08:34, 2:08:35]: I believe that it would, yes. [2:08:35, 2:08:36]: All right, thank you. [2:08:38, 2:08:44]: All right. Any other any other questions? Steph, hold up hold on folks. Calm down please. Calm down. [2:08:45, 2:08:47]: Calm down. Any other questions for the council? [2:08:48, 2:08:49]: Any questions from the council? [2:08:50, 2:09:02]: Uh Mr. Uh Ryan. Yes sir. Please step forward please. The applicant. You said the applicant's here? Yes. Did the applicant want to add anything in reference to what you've said thus far? There we go. Stemmed up. [2:09:09, 2:09:11]: And name and address sir in and on your company. [2:09:12, 2:09:14]: Absolutely. Uh good evening. [2:09:15, 2:09:16]: My name is Zach Murray. [2:09:16, 2:09:19]: My address is thirty Macon Street, McDonald, Georgia. [2:09:20, 2:09:21]: Three zero two five two. [2:09:26, 2:09:30]: Uh overall I wanted to start by [2:09:32, 2:09:35]: the vision statement of Stockbridge. [2:09:35, 2:09:40]: I'm a huge fan of Stockbridge overall. The vision statement says [2:09:40, 2:09:47]: That your vision is to be the most progressive business and family oriented community in Metro Atlanta. [2:09:48, 2:09:54]: With a focus to enhance quality of life initiatives, which promotes [2:09:56, 2:10:01]: А сустей, ворк, плей, ермент. [2:10:04, 2:10:08]: What myself and our partners at TELIS Partners [2:10:08, 2:10:13]: want to do is create that live, work, play environment. [2:10:15, 2:10:18]: That would put us on the map to be the most progressiv. [2:10:19, 2:10:21]: in the metropolitan Atlanta area. [2:10:28, 2:10:33]: Are you trying to show us a pr okay, there I guess I was I was wondering if you trying to show us a presentation there? Yes, sir. Okay. [2:10:43, 2:10:47]: So how this started, I am a resident of Henry County. [2:10:47, 2:10:56]: And I saw the investment that you all made into your own city with the amphitheater. I saw the plans that you had to revitalize your downtown. [2:10:57, 2:10:58]: And I want to be a part of it. [2:10:59, 2:11:03]: So I initially wanted to find [2:11:03, 2:11:04]: Something [2:11:04, 2:11:08]: That could be an addition, that can increase the value. [2:11:09, 2:11:10]: As I saw [2:11:11, 2:11:16]: Тwенти сикс. Дара деслат. Даса дumping сайт now. [2:11:16, 2:11:22]: That has homeless population living there, and one of the most opulent communities that we have. [2:11:23, 2:11:25]: And the spy community. [2:11:28, 2:11:29]: I began to [2:11:30, 2:11:37]: get with my partners and we created what we wanted to turn into tranquil trails. [2:11:44, 2:11:47]: This is the oversight that you saw before. [2:11:48, 2:11:52]: This is a 3D rendering over the top of it. [2:11:53, 2:12:05]: This would include a Cabana Bar and Grill, which is the building that you see on the screen now. That is also the association office as well as the leasing office for the multifamily units. [2:12:13, 2:12:19]: I know I've heard plenty of meetings where a community has cried out. [2:12:19, 2:12:25]: For retail, for healthy foods. We have seen sprouts come and they just never come through. [2:12:26, 2:12:31]: It was important to me that what we brought was a signification of quality. [2:12:31, 2:12:37]: Uh so we do have all signed leases and commitments for all of our retail space. [2:12:38, 2:12:41]: Our anchor being nourish and bloom. [2:12:42, 2:12:54]: Uh I will pause in my presentation and invite the founders and owners of Nourish and Bloom to the podium. They are excited to become a part of Stockbridge enough to where they wanted to come speak to you yourself. [2:12:58, 2:13:06]: They've also it's a slightly different product than what they have at Trilith, but I I'll let them explain that. [2:13:06, 2:13:11]: Welcome. And introduce yourself and your lo uh location of your address please and company. [2:13:11, 2:13:15]: So good evening everyone. My name is Jalea Hemings. [2:13:16, 2:13:18]: Hello, everyone. My name is Jamie Hemmings. [2:13:18, 2:13:31]: And we're both residents of Henry County and McDonough in zip code three oh two five two as well. And we're really excited about the opportunity to bring the future of shopping. [2:13:31, 2:13:33]: to the south side. [2:13:33, 2:13:36]: Of Atlanta, especially Henry County, where we all live. [2:13:37, 2:13:42]: Prior to us opening Nourish and Bloom Market, we found ourselves traveling. [2:13:42, 2:13:54]: to Atlanta to find healthy options for our family. And I said, that's the one thing that I wish we had here so I wouldn't have to leave on the weekends and go to another city to get our needs met. [2:13:55, 2:14:00]: So when Zack presented us with the opportunity that was here in Henry County, Jamie and I jumped on it. [2:14:00, 2:14:07]: Because currently we have a location right now in Fayetteville, um under the in the town of Trillieth. [2:14:07, 2:14:23]: where we've been able to bring Nourish and Bloom Market. So Nourish and Bloom Market is the first autonomous grocery store in the southern United States, which is a huge accomplishment. We were excited to bring it to Georgia. All the other tech companies weren't thinking of Georgia as a place to bring this level of technology. [2:14:24, 2:14:44]: But in the next five years, you're gonna start to see this type of technology where you can walk into a store with your app, be able to get your needs met without having to go through a traditional checkout process. Through the pandemic, is when we created this, when everyone was looking for touchless options. And we wanted to be that solution. So if someone is sick, you still are able to get your growth. [2:14:43, 2:15:00]: groceries. If for any reason that your store can't be open or different holidays and so forth, the store can still run. But we have, and I can tell you with our store in Trillith, have have more staff than we would have if our store was a traditional grocery store. So we are training for jobs of the future. [2:15:00, 2:15:06]: We're bringing what the future of grocery looks like, but most importantly, we're bringing an offering that we do not no longer will have to go. [2:15:07, 2:15:07]: To Atlanta. [2:15:08, 2:15:12]: to go get, we will be able to get it in Henry County, which we are really excited about. [2:15:12, 2:15:23]: And then also we have robots as well. And so the part of the robots is is that if you need food and you're not able to come to us, we can come to you. If you don't want to have a human come to you, we have robots that [2:15:23, 2:15:31]: are able to also come to you. So we're really excited about bringing this to our home and we're open to any questions that you have. [2:15:32, 2:15:44]: Okay. Um all right, good. Council. Any questions for Zach or the these uh this one wonderful couple here? Sure. Does anybody else want to speak before? anybody questions on this side? [2:15:44, 2:15:47]: Go right ahead please. Uh go go ahead, Miss Ms. Gantt. Hi and welcome. [2:15:47, 2:15:58]: Um, could you tell me uh if this project is approved, what your starting time frame would be to consider starting to break ground here? [2:15:58, 2:16:18]: Sure. You want to talk to that? Well, you would. Yeah. I our our goal overall is as soon as possible. If we were approved tonight, we would be immediately working on the LDP. Uh we don't want any delays. I feel the time is now. I feel what we can add to the community. [2:16:18, 2:16:22]: community, we we are ready and prepared to move forward as as soon as possible. [2:16:24, 2:16:26]: When would you open? I'm sorry. When would you open? [2:16:28, 2:16:29]: When would you open? [2:16:29, 2:16:43]: Uh the your build out is how long? So our build out is around six to eight months. So we're looking at next year if all things go according to their their lease is contingent upon the zoning. Uh so [2:16:44, 2:16:51]: And is it um the same exact concept in as the one in Fayetteville right now that you have? [2:16:51, 2:16:55]: Yeah, so our actually our plan is that [2:16:56, 2:17:16]: So the one that we currently have in Fayetteville, it's only 1400 square feet. So the one that we would be bringing here to Henry County would actually be much larger. And then also the concept that my wife had talked about earlier as far as having robotic delivery, that would be something. [2:17:16, 2:17:36]: Something that is very unique to this space itself because that is not something that is actually planned out in the current location that we have. But talking with Zach, they can actually make room and have paths set up for the robots to go through. [2:17:35, 2:17:38]: throughout the community and actually deliver. [2:17:38, 2:17:58]: So um and then one other thing on the product offering. So we'll be bringing more of a product offering. So we'll have uh you know, butchers and seafood and bakeries all within this concept, which are too small our current location is too small to have that. And we're also gonna bring in our bistro. So we our whole mission is about real food and real products. We started this because my [2:17:58, 2:18:18]: Son had autism and we learned the importance of diet. And so for us, we want to make sure that we're bringing the best and the highest quality ingredients. So you'll have our bistro, but you'll also have fresh meats, fresh fish, fresh produce, and a bakery as well added into our concept. But also the biggest thing for us is that for the [2:18:18, 2:18:38]: community itself, it would be great to to get their input as far as what type of products that they would like within the store itself. We want them to be a part of you know this process. So for them to give us their input so that we can see what products they actually want within the store, we would actually uh [2:18:38, 2:18:40]: preferred that feedback from the community. [2:18:42, 2:18:45]: All right, thank you. Any other questions? Ms. Alzheimer, go ahead, please. [2:18:45, 2:19:05]: Certainly uh thank you all. You know, I remember um going over to Fayetteville, and then uh you all were so hospitable. It was beautiful over there uh at Trilleth, and you took me on a tour of the store, not knowing that you would be coming here to Stockbridge at some point, but I certainly was uh uh I certainly appreciate you all leaning forward. [2:19:05, 2:19:25]: Forward and wanting to be in Henry County. I remember you guys want Good Morning America, I believe it was, and they highlighted what you all were being able to do. So certainly, you know, you bringing a quality product here. So the product uh organic would be available too in terms of what you're [2:19:25, 2:19:32]: doing and then the square footage you say was fourteen hundred over there. What what would be what would be your approximately square footage here? [2:19:32, 2:19:40]: It would it would be uh six thousand square feet. It would be six. So this would be a larger location that we would be bringing to Henry County. [2:19:40, 2:19:58]: Mm-hmm. Absolutely. And and and I love what you said, which is you want to invest where you live. Correct. You know, you're tired of going to Atlanta like most of us are for those particular uh things and when we can have it right here in our community. So uh thank you. I appreciate that. Thank you. Thank you. [2:19:59, 2:19:59]: Mm-hmm. [2:20:00, 2:20:13]: You have questions, council. All right. Thank you. Well is the public question? No. Public hearing. Oh I'm sorry. Sorry. Do you have anything else for before I open up? I do. [2:20:14, 2:20:23]: Next after this we have a multifamily. Okay. And uh I do have the acquisition, uh Jonathan Schrader. [2:20:23, 2:20:38]: uh from tell us uh who will speak he is in charge of more of the construction and the acquisition of it so I would uh like him to come speak to what this multifamily uh development would be [2:20:42, 2:20:44]: Your name and organization, please, sir. [2:20:44, 2:20:52]: Uh Jonathan Schrader, TELUS Partners, uh 4983, New Peachtree Road, Chambley, Georgia. [2:20:52, 2:20:53]: Okay, go ahead, please. [2:20:54, 2:21:14]: Um we just want to make the comment that um if you read the staff's analysis and their approval of it, you know, we stay within the one key factor of the unified development code within Stockbridge is that this is encouraging the most appropriate and best use of the land in [2:21:14, 2:21:24]: buildings for the city. I mean we're five hundred feet from a highway or half a mile or from a state highway, half a mile from a major highway. [2:21:25, 2:21:45]: We put nice workforce housing in a luxury manner on the ground for people that are young professionals, people before their families, to encourage them to come live in our resort style apartments to help raise up the revenue and tax basis of the city. Um, you know. [2:21:44, 2:21:52]: When mixed use projects are done correctly, they raise the property value around it. You know, nourish and bloom, a nice commercial. [2:21:53, 2:22:07]: retail aspect to a property is good for the community. It takes a empty, vacant dumping ground, like Zack said, and turns it into a flourishing community, residential and commercial. [2:22:08, 2:22:11]: Okay. Good. Any questions for this gentleman, Council? [2:22:12, 2:22:22]: Anybody? Certainly. Go right, please. If you would talk about some of the other projects that you've done to show that you have the track record to be able to complete this particular project. [2:22:22, 2:22:36]: Um currently we've completed six projects throughout Georgia and Florida. We have five other projects currently in production. We have a big mixed use project up near Kennesaw, the university off Cherokee Street. [2:22:37, 2:22:57]: where we're doing 500, we took we assembled sixty-five trailer park lots and turned it into, we're turning it into five hundred and seventy-six apartment units, both garden and mid-rise, as well as bringing a Lydol, a senior living facility. [2:22:57, 2:22:59]: and other retail commercial [2:23:00, 2:23:05]: Two Kennesaw that took a desolate trailer park that was about half [2:23:05, 2:23:08]: occupied and then turning it into a good [2:23:08, 2:23:12]: next use project for the city of Kennesaw that they're very excited about. [2:23:12, 2:23:28]: We also have a project in Bolton Road that's very similar. We're a dead retail center. We're building an apartment complex with it based on its current zoning and then rehabbing the commercial aspect for that. [2:23:29, 2:23:49]: Uh retail owner who has signed up tenants very similar to Nourish and Bloom to occupy their retail that's been um not occupied for several years. Okay. One other question. Zach or the you sir, talk about the total investment because in order for you all to make this sizable type of investment, you've done the homework. [2:23:49, 2:24:06]: where you're investing millions of dollars in this development. So let's say if it was totally w once it's totally built out and you plan on doing the commercial and the residential, uh what type of money are you all investing in this community that uh you've chosen? [2:24:06, 2:24:15]: This is close to a hundred million dollar project with the um apartments, townhomes and then the commercial aspect to it. [2:24:16, 2:24:21]: Okay. So absolutely we s um Okay. Thank you, certainly. [2:24:22, 2:24:23]: Ms. Gantt, go ahead, please. [2:24:23, 2:24:43]: And currently you had mentioned and I know that everyone's has spoken to um some of Mayor and Council, at least I'm sure, at some point, you mentioned uh some of the commercial properties that the commercial pieces. Could you elaborate a little bit more on that? On um you have LOIs, you have people ready to go inside of them. [2:24:43, 2:24:52]: Now. Uh they yeah. They they are uh currently um working on the smoothie bar is actually already in. [2:24:53, 2:25:13]: Um the contingency leases that we have is Nourish and Bloom and the Cabana Bar and Grill. But all the other leases are signed and executed and out of good faith they've already started to work. There's a sports bar as well as a brunch restaurant a and a uh uh accounting firm that we [2:25:13, 2:25:15]: will also be inside of that platform. [2:25:15, 2:25:35]: Okay. And and Mr. Um Schrader. Schrader. Schrader. Yes. Schrader. Yes, ma'am. Um, you mentioned six projects that you're work currently working on. Have you completed any projects? Yes, we've completed seven projects or eight projects to date. Um two up in Gainesville, one in Panama City. [2:25:35, 2:25:39]: Savannah um wild light down in Florida. [2:25:39, 2:25:52]: Um Old Moultree, which is down in St. Augustine and Wildwood, Florida, are the ones we've completed. And then we have Kennesaw, which is two projects all going on Bolton Road. [2:25:54, 2:26:13]: Crescu, Florida, Santa Rosa, Florida, and then we have two other projects that we own the land and are currently zoned, and we're going through the uh civil design for the LDP drawings, one in Panama City Beach and one in Panama City. Yeah. This is the uh product near Gainesville, Oakwood, Georgia. Uh the completed product. [2:26:13, 2:26:20]: And are these projects uh the ones that are completed, uh s very similar to what you're trying to design here? [2:26:20, 2:26:36]: Yes, ma'am. It it is. We're we're fully integrated as a company. We're the developer, we're the G C and we make up most of our supply chain. Um so with that we've been able to control our costs and our delivery in this environment we've dealt with the last three years. [2:26:38, 2:26:58]: Sir, one more if I could. Go right, please. Yeah. Now there's been a lot of concern, especially from this audience, about the financial wherewithal of companies. We had a situation where this uh highway one thirty-eight hotel opened up, the b the the the person went out of business. Thank God somebody's finally bought that property and [2:26:58, 2:27:12]: plans on commit uh completing the best western at this point. Um we're waiting on the permits to come in. Talk about your financial wherewithal in terms of your balance sheet uh to complete the project, your network for the or the company, so to speak. [2:27:12, 2:27:13]: Well [2:27:14, 2:27:34]: The way we have currently we have about a billion dollars worth of projects in our pipeline. That's on property we own or under contract for or in the design phases on. We have several equity partners that have used the ten thirty-one exchange over the last ten years to [2:27:34, 2:27:54]: Place all their money and they just continue to roll it with us. So we're very solvent and control our own dusty in that standpoint. Obviously, the capital markets have changed a little bit, but with our vertical integration, with our GC in-house, our material supply companies in-house, we can control our unit costs. [2:27:54, 2:27:57]: [8877.9, 8881.7]: Mr Srady, you said a billion dollars, is that correct? Yes, sir. Thank you. [2:28:03, 2:28:05]: Any other questions from the council? Mayor Ford. Yes, sir, go ahead, please. [2:28:06, 2:28:26]: I'd like to thank you two gentlemen for bringing this um to the city of Stockbridge for our consideration. Uh you mentioned a number of uh cities uh where you have implemented these ideas. Can you sort of give us uh an ideal of the the response, uh the reaction to [2:28:26, 2:28:30]: to the citizenry and the occupancy in in those cities. [2:28:30, 2:28:41]: Uh Kennesaw is very excited to have us come on board. We've been working on that project for close to four years now with the parcel combination. [2:28:41, 2:29:01]: The rezoning, the extension of a public road, the dedication of that public road, the property swaps within it, they were very receptive to it because we took a trailer park and are turning it into a mixed-use um project with a senior living. [2:29:01, 2:29:16]: living, two apartments, a grocery store anchor, and then several other retail um commercial applications. Our our goal is always to add value, uh no matter where we are going. [2:29:17, 2:29:37]: You know, I I would think that um maybe in Florida or California, I think they'll probably sort of use to this style of a resort style. Uh I think bringing it in this region here, somewhat in the south and maybe in some of these rural areas, uh I I would think this is a pretty big deal for [2:29:37, 2:29:57]: I I would think that uh uh especially um young professionals would probably just gravitate toward this type of uh living and development. So would would you say that's a true statement? Yes, sir, I would. Yeah. All right, thank you, Mira. Now you're [2:29:57, 2:30:13]: Any other questions, comments from the council? I have one more. I have a few. So um you're targeting young yuppies, basically, you're targeting young earthquakes. Also empty masters. People people that have sold their single family home and are looking for a lock and leave mentality. [2:30:13, 2:30:32]: Okay. But you're n y so uh this property then I'm assuming won't have playgrounds and things of that nature. Uh I have more dog parks, um, high end pools, stuff like that. Trails, walking trails. And how many um bedrooms are the uh in the unit apartment units? [2:30:32, 2:30:45]: Uh it's about fifty fifty on single or one bedrooms and two bedrooms. We do offer eight, three bedrooms, just as a variety for people who like two bedrooms with an office, stuff like that. [2:30:45, 2:30:50]: How many three bedrooms? It's a two eight out of three hundred and eighteen. So two percent. [2:30:52, 2:31:04]: Okay, so eight total units. Yeah, two bedrooms with an office. Yeah, but this this the apartments for this one have a hundred and fifty five one bedroom, a hundred and fifty five, two bedroom, and then eight three bedroom. [2:31:06, 2:31:08]: Let me see if I can show that. [2:31:11, 2:31:15]: Thank you, thank you for that. Anything else, Ms. Gat? [2:31:15, 2:31:17]: Um no, not at this time. [2:31:18, 2:31:33]: Okay, council, anything else? Yeah, oh go ahead, please. I have a question. Um you know, dealing with make use and you were dealing with residential and um commercial. Um and the portion that's you're talking about with the um [2:31:34, 2:31:41]: The residential portion that's not dealing with the town homes. How would that be managed? [2:31:42, 2:31:49]: Uh the townhomes are planned to be fee simple. Well not the townhomes. The apartment piece. How would that how would how would that be managed? [2:31:50, 2:31:53]: Uh be managed by our management company that we have. [2:31:53, 2:32:00]: Yeah, all in house. Yeah, we have an in-house management company that manages our properties and lease ups and um [2:32:01, 2:32:02]: Ongoing operations. [2:32:03, 2:32:11]: So it's a company that you actually use in now that uh would they would they also similar to our G C and our supply chain, we also have a management company. [2:32:11, 2:32:17]: And all internal inter underneath the umbrella. Under your properties now, does that management company also have his own security? [2:32:19, 2:32:20]: Typically, yes. [2:32:22, 2:32:32]: We have one property that doesn't they have it's gated and it's in Gainesville so they don't really need much security, but typically it just depends on the area and and operational needs. [2:32:33, 2:32:34]: Okay. [2:32:36, 2:32:40]: Okay. Any other questions? Miss Gar uh Miss Barber, go ahead please. [2:32:43, 2:32:51]: In terms of the egress and ingress um of this development, can you show a [2:32:52, 2:33:02]: plan of or a drawing of the streets that are there. Um [2:33:05, 2:33:07]: Let's get up the site plan. [2:33:13, 2:33:23]: I did take a drive over to this property and I did notice that it has become a dumping ground. Um but I was most uh concerned about [2:33:23, 2:33:43]: how people would access um the residential side and how those would access the commercial side as well. There's a median. Tributary parkway, which is kind of a this road that is already in coming off of 138, would be our main access point. [2:33:43, 2:33:55]: have another egress uh here on the other side of the plaza. There's also two that is on Spive Road as well. So there's four total that currently exist for the property. [2:33:55, 2:33:59]: I saw that. I do have um a question though. [2:34:00, 2:34:00]: So [2:34:03, 2:34:07]: If someone doesn't want to turn for whatever reason left. [2:34:07, 2:34:08]: If they're going [2:34:09, 2:34:10]: West. [2:34:10, 2:34:11]: On one thirty eight. [2:34:11, 2:34:13]: And they passed the light of [2:34:13, 2:34:14]: Spivey Road. [2:34:15, 2:34:17]: The only other way they they can access. [2:34:18, 2:34:19]: This development. [2:34:19, 2:34:21]: is to go up and make the U turn. [2:34:22, 2:34:42]: That point where they would make the U-turn, I did notice that there was, and I don't know if I'm using the correct term, a stub out or another access point. Another median code. Is that a part of this? Another median code, yes. Uh as a part of this, we're required to work with state DOT. Uh it is an [2:34:42, 2:34:57]: in our best interest that we be able to mitigate that, but that's not something we can change on our own without consulting the state. And you're talking about the out parcel on the far left. She's talking yeah, this parcel. We have plans to add that, just we haven't done it yet. Yeah. [2:34:59, 2:35:09]: that would become a part of your development? If we had a choice, yes. We just we're working with that property owner to see if they're willing to let it be part of it. [2:35:10, 2:35:13]: So it isn't currently. Currently not. Thank you. [2:35:18, 2:35:19]: Any other questions, Ms. Barber? [2:35:21, 2:35:38]: Okay, and council, any other questions? Gentlemen, thank you. Appreciate it. Okay. Thank you. Uh this is open. It's uh public hearing. So I'm gonna open a public hearing. So I'm gonna start off all as normal on my left side, which is uh over here, for any comments for approval. [2:35:39, 2:35:49]: Approval of this particular project. Approval this project. Please approval project, please la stand up right here. Yeah, line up right there if you it's approval. All right. Anybody else want to uh from the actual [2:35:50, 2:35:53]: My left side. Anybody in the middle for approval. Okay. [2:36:00, 2:36:00]: Excuse me. [2:36:06, 2:36:08]: No, I don't know. [2:36:09, 2:36:27]: I didn't know that was poll. One second here. No. Well Clerk, uh uh th that is a that is a n a necessity that needs to happen. I thought they what they stand in, they give their name and address, they can speak. [2:36:35, 2:36:35]: Uh-huh. [2:36:39, 2:36:48]: Okay, I will do so. I I was gonna do so. All right, so uh once again this is for the f uh for positive comments and forward project, okay? In the middle, anybody? [2:36:49, 2:36:51]: Mind far right side anybody. [2:36:51, 2:36:52]: Pause the comments. [2:36:54, 2:37:04]: If that's the case, okay, so what it amounts to, I leave where you come when you come to the podium, name and address and speak into the mic, address me as a presiding officer, please. Point point of order, sir. What [2:37:05, 2:37:09]: What's what's the point on it? Are we doing the ten minutes for and ten minutes against? That's in the city code. [2:37:11, 2:37:17]: Ten minutes for and ten minutes against. Right. Ten minutes three, stand up, stand up time, time out, time out, time, time out, time out. [2:37:17, 2:37:20]: Now I'll give a I'll give each person two minutes to speak. [2:37:20, 2:37:23]: Each person gets two minutes to speak. Matter of fact, um Madam Clerk. [2:37:26, 2:37:29]: I'm gonna give them two minutes. I need for you to have m have the timer ready to go. [2:37:32, 2:37:33]: Oh shit. [2:37:45, 2:37:47]: They don't have that. [2:37:48, 2:37:50]: Mm-hmm. [2:37:51, 2:37:54]: I'm gonna give give these these individuals two minutes to speak. [2:37:55, 2:37:56]: Four. [2:37:56, 2:37:57]: I'm gonna give'em I'm gonna go. [2:37:58, 2:37:58]: Excuse me? [2:38:03, 2:38:04]: You can't set the clock for two minutes? [2:38:06, 2:38:08]: But the clock is set for what is the clock set for? [2:38:10, 2:38:11]: What's the clock set for, ma'am? [2:38:13, 2:38:16]: You you cannot manually change that to two minutes. [2:38:22, 2:38:32]: All right. But once you start the clock, you can stop it at any time, it can stop at a particular point and you can restart it again. Is that correct? All right. Start it for ten minutes then. Mr. Marshall, please, name and address. [2:38:32, 2:38:41]: Uh Mayor Ford and City Council members, my name is Charles Marshall. My wife and I live at 140 Somerset Hills in the Eagles Landing area of unincorporated Henry County. [2:38:41, 2:38:50]: I want to first thank the thank you and the members of the city council for allowing this to be a public uh opportunity to come and weigh in on this all important issue. [2:38:50, 2:38:56]: We've lived uh in the English landing area for about eleven years and have thoroughly enjoyed being a resident of the community. [2:38:57, 2:39:17]: And we try to be active and involved with some of the policies and decisions affecting the development of the city of Stockbridge. Like many of us, our property borders right up against the property lines of Stockbridge. So we inherently have an interest in how the city develops and how it's managed. And we will be applying for annexation to the city. [2:39:18, 2:39:19]: So tonight we are presented. [2:39:20, 2:39:32]: Uh we have been presented with plans to build a beautiful mixed use development with many attractive amenities and concepts. I like many have never seen such a state of the art development and is creating an awful lot of excitement. [2:39:32, 2:39:40]: And I think that's because we wanna have a robust community with all the things that make us appreciative of one another as neighbors. [2:39:40, 2:39:47]: And to bring us all together as one. Being a resident of Eagles Landing Country Club community, I'm reminded of our cityhood movement. [2:39:48, 2:39:53]: Where we wanted to separate from the city of Stockbridge because we felt Stock Bridge was moving too slow. [2:39:54, 2:39:56]: We felt that development like this [2:39:58, 2:40:05]: What is being proposed tonight could never come to our community unless we took it upon ourselves as a new city to make that happen. [2:40:05, 2:40:22]: Eagles Landing would have loved to have brought such a development like this to our area because we knew that this would just be a start for a more vigorous growth of upscale development, bringing us better restaurants, corporate centers, shopping centers, maybe even a Whole Foods grocery. [2:40:22, 2:40:42]: And just as importantly, more sales tax dollars to better fund a stronger city government so that we can provide that much-needed traffic infrastructure improvements to better serve the people and making this a better place to live, work, and play. I see these things happening now. I see you as the city government making a very noticeable effort in bringing our vision of a great city. [2:40:42, 2:40:45]: I see it with the allocation. [2:40:46, 2:40:47]: What's semi? Is that ten minutes? [2:40:50, 2:40:50]: What [2:40:50, 2:40:58]: Okay. I did say that initially, but then you told me you couldn't you couldn't you can do it. [2:40:58, 2:41:07]: I didn't last you. I'm sorry, go ahead, please. Go ahead. I started at eight. [2:41:08, 2:41:28]: Okay. Well okay, that that's initially I thought we were gonna do that, but you but you told me you couldn't make it I wanted everybody to get two, but if but if you had to attend and I wanted to be able to s when we get more people I wanted to be able to stop it just like you did at that point. Okay, we may run out of time real quickly, but I want him to finish. Go ahead and run it. There's only I think there's only two individuals. Time out folks, timeout. [2:41:28, 2:41:29]: Mm-hmm. [2:41:30, 2:41:31]: Time out! [2:41:32, 2:41:46]: Okay? Listen. So we're we're gonna we're gonna we're gonna ten minutes, we'll start with ten minutes, all right? So let him finish and then uh and then when he stops when he's finished, stop it, and then the next person that comes up and then and when she starts gives her name and her address and you start it again. [2:41:46, 2:41:47]: Okay. [2:41:47, 2:41:54]: Wait, we're gonna let him do ten minutes. We're gonna restart this and let him continue. [2:41:55, 2:41:56]: No, no. [2:41:56, 2:42:11]: Well when he gets fin well when he gets finished and when he gets finished when he gets finished. I just have another thirty seconds. Okay, got it. Just let him finish. All right, then uh stop it. This next lady will come up, she'll give a name and address, and we'll start it. All right, and we'll see where we end up. [2:42:11, 2:42:31]: All right. Now thank you. Time out, folks. Go ahead, please. To continue, I see you as our city government making a very noticeable effort in bringing our vision of a great city first. I see it with the allocation of T-SPLOST funds to improve our traffic infrastructure with the widening of roads, installation of traffic lights, creation of trails, parks, sidewalks as part of a [2:42:31, 2:42:51]: Master plan, all to address the needs of a growing community. Many of us feel that our decision or your decision to approve the development of a state-of-the-art mixed-use development is just as important and just as impactful as your approval was in the development of the Bridges of Jodico mixed use development, as it was that gorgeous amphibious. [2:42:51, 2:43:04]: amphitheater and with the Cumming College uh Cultural Arts Center, the formation of a police department, and your visionary concept of a world-class stock bridge city downtown. As you know, the Eagles Landing community has formed a mass association. [2:43:04, 2:43:24]: An organization of six subdivisions within the Eagles Landing area, which now all work with the city of Stockbridge in keeping the area attractive, vibrant as we partner towards a brighter future. This must be the way for all of us. Together we can fix the infrastructure problems, beautify the city, and proactively plan for these types of development as we move forward. [2:43:24, 2:43:36]: to better the development of the city of Stockbridge. I support the decision of approving this mixed use development. Thank you. Sir. Now s now stop it, please. Stop stop it. Thank you very much. Thank you, sir. Ma'am, come on up, please. [2:43:39, 2:43:59]: Give it one you give your name and address. When she finishes her name and address, start the clock, please. All right. Um Mindy Mayers, um 1008 Peaks Point, McDonough, Georgia, 30253. I just want to say I support the mixed use development. I've seen one similar in Fayetteville, uh been to Nourish and Bloom. It is awesome there. Um also I've lived here for about twenty years. Um [2:43:59, 2:44:15]: Um I rarely go to one thirty eight. I just think that there should be some other things there to attract folks to one thirty eight. So I just want to say I support it. Thanks. Thank you. Now you're gonna now we're gonna reset because no more. So reset about the ten minutes and we'll talk. Yes ma'am? [2:44:22, 2:44:22]: Okay. [2:44:27, 2:44:30]: Okay, so y okay, you announced the fact that it was saved. [2:44:31, 2:44:34]: Stamp stand by, sir. I'm sorry. [2:44:39, 2:44:54]: Okay. Thank you. All right. There was no well else four. All right. Four okay. I'm sorry, did you okay, come on up, please, name and address. Did you uh did you s where where we stand with the where did we stand? She's four. So where do we stand with the time frame here? [2:44:57, 2:45:00]: Okay. Wait, after she gives her name and address, start the clock again, please. [2:45:03, 2:45:13]: Yeah, hi. Um my name is Grace and I live um at two fifteen memory lane, Stockbridge, Georgia. I live right on the corner of McDonald's, um right there for Spear Road. [2:45:13, 2:45:22]: And um I just wanna say I'm for the new development, the mixed development. I've been a resident here for five years now and I see Stockbridge. Um this was like my [2:45:23, 2:45:26]: This was the community I wanted to live in, you know, Stockbridge and um [2:45:27, 2:45:38]: I see the change that's going on here and um I'm looking forward to continued change. You know, you got the police department, the ample theater. When I first came here, I started make when I first moved here, I started making the meetings here. [2:45:39, 2:45:59]: with the um with the council and um you've done a good a good job so far in in changing stock stockbridge and i like to see more change and i i live exactly on the corner so if anybody's gonna be impacted as well it's gonna be me as well so i i'm for the change thank you thank thank you okay stop the clock okay now [2:45:59, 2:46:03]: This is four. Once again four. Anybody else four? If not, we'll reset the clock. [2:46:05, 2:46:17]: Hearing none, seeing none. So we reset it to 10 minutes. All right, now, looking for or against this particular project. I started with my very left, my left side, this section over here, and line up on that side if you if if you're interested in talking. [2:46:18, 2:46:26]: Okay, on my left side, anybody want to talk against sign line up over. In the middle? Anybody line up on this side over here? Anybody else in the middle wanna talk? [2:46:26, 2:46:34]: Against this project. Okay, on my far right side. Anybody wants to talk? Line up on this side, on this my very left side, this side. Okay? [2:46:37, 2:46:41]: Line line up in this side, please. On my far left side, line up this side. [2:46:49, 2:46:51]: All right, now this is how we're going to do this. [2:46:51, 2:46:54]: So how we're gonna do this. It's gonna start at 10 minutes. All right. [2:46:55, 2:47:08]: You've got other people you want to talk. All right, we're going to start with 10 minutes. Well don't not just yet, sir. Let me explain this. Ten minutes. All right. When you after you give your name and address, the clock will start. When you finish, it will stop. [2:47:09, 2:47:19]: All right. Now granted, start at ten minutes, that means that there's a limited amount of time. So the longer you talk, the more time you kick off kick off the clock, and maybe somebody else may not get a chance to speak. [2:47:19, 2:47:26]: All right. Uh hold on folks, hold on. Tat hold on. Hold on. We're making I'm making the rules. And now here now here's what's gonna happen. [2:47:26, 2:47:28]: If we run out of time. [2:47:28, 2:47:34]: I'm gonna give it to the council, decide if we're going to continue on with the comments. [2:47:34, 2:47:36]: Point play. Point play. [2:47:36, 2:47:37]: All right. [2:47:37, 2:47:38]: So [2:47:38, 2:47:41]: So hopefully you you're c concise and to the point. [2:47:42, 2:47:43]: All right. [2:47:43, 2:47:44]: All right. [2:47:44, 2:47:47]: Make sure you address me as a presiding officer. [2:47:47, 2:47:49]: Now speak directly into the mic. [2:47:49, 2:47:51]: Mayor Ford? Yes, sir. [2:47:51, 2:47:53]: May I make a statement just briefly? [2:47:54, 2:48:02]: Uh, citizen, I I I I think it would be very respectful if you know that there are other folk that really do want to speak. [2:48:03, 2:48:23]: I would appreciate if you just speak to the point and allow the person behind you to get their comments in as well. Because we do want to hear from everyone, but if one person is going to take up all of the time, someone behind you is going to really be upset because they didn't get a chance to speak. [2:48:23, 2:48:27]: speak. So let's just be mindful to let everyone get in. [2:48:27, 2:48:32]: These are standard rules, the ten minute rules, these are standard. This is not something that we're making up. [2:48:33, 2:48:33]: Thank you. [2:48:34, 2:48:34]: All right. [2:48:36, 2:48:38]: The clock's been set reset at ten minutes. [2:48:39, 2:48:41]: Okay. Go ahead, sir, your name and address, please. [2:48:41, 2:48:51]: Mayor Ford, I'm Charles Williams. I live at five thirty-four Creekstone Drive, Spive Glenn Subdivision. Thank you. Go ahead. The thing I we worry about in our area [2:48:52, 2:48:57]: Police protection fire department is waveled all round rock quarry. [2:48:57, 2:48:59]: Then starve itself. [2:48:59, 2:49:05]: At one time we were going to get a fire station over by Ingalls by um [2:49:05, 2:49:06]: Thank you. [2:49:06, 2:49:14]: County commissioner, but that fell through because of the station and it had asbestos downtown in Stockbridge. [2:49:14, 2:49:15]: How down by Krogers. [2:49:16, 2:49:29]: And um the water over in that area comes from Clayton County, for your information. So those are things we worry about, the protection and all. Thank you very much, sir. Thank you. Please stop the clock. [2:49:36, 2:49:37]: Name and address, please. [2:49:38, 2:49:43]: Ah my name is Marion D. Calhoun and I live at six oh eight Creekstone Court [2:49:43, 2:49:45]: Jonesboro, Georgia. [2:49:46, 2:49:47]: First of all I like to say [2:49:48, 2:49:53]: I do not care about what's going on in Fedville. I don't care about what's going on in Marietta. [2:49:54, 2:49:58]: I care about what's going on at six oh eight Creekstone Spivey Glenn. [2:49:58, 2:50:04]: I moved there for the reason that there was not all of this what you all are trying to do. [2:50:05, 2:50:06]: Second of all [2:50:07, 2:50:09]: You guys have already made your decision. [2:50:10, 2:50:13]: And you trying to thrust this down our throat like it's gonna be okay. [2:50:14, 2:50:16]: people that are speaking on the floor. [2:50:16, 2:50:23]: They don't even live in the area. They live somewhere else. So they're here trying to tell us how we wanna live on our side of town. [2:50:23, 2:50:25]: I don't like it. [2:50:25, 2:50:36]: Now I am a community activist and I don't mind voicing my opinion when my opinion needs to be voiced. And right now, we don't want your program, your project, [2:50:37, 2:50:52]: I love Zach. Zach and I work together on many pro on projects. He has been very instrumental in helping me with other stuff. But Zach knows me. He knows that when I put my foot to something, I just go for it. And right now, you see a whole bunch of people in here. [2:50:53, 2:50:57]: We don't have a voice. I heard somebody up there say [2:50:57, 2:50:59]: That you guys don't have a choice. [2:50:59, 2:51:02]: Well, if you don't have a choice in this right here. [2:51:03, 2:51:05]: You all don't need to be up there. [2:51:06, 2:51:11]: And if you can't help us with what we want, we don't want you up there. [2:51:11, 2:51:31]: Because this is not fair. You can't thrust this down our throat and tell us it's okay. Because it's not okay. We don't want that mixed whatever. And if we had to have it, why can't y'all do it in phases? Why you got to throw all of this in our face when we got drug problems, we got home. [2:51:31, 2:51:47]: Homeless problems. I don't never hear y'all talking about a mixed unit for people to live in a homeless program. None of that's going on. But you want to get rich with tax dollars so we can substitute whatever it is y'all want to substitute. It's not fair. [2:51:47, 2:51:55]: And it y'all need to put a stop to this because it's wrong. It's just totally wrong. Okay. Stop the clock. [2:51:58, 2:51:58]: Next question. [2:52:01, 2:52:21]: Go ahead. Robert Payne, 303 Corporate Center Drive, Stockbridge, Georgia. Mayor, Counsel, I want to let you know that I am a real estate agent. I do speak as a place of an expert. I sell$20 million a year in real estate. What you do need to know is I've got the facts right here. These are the stats I pulled today from MLS. These are the sales in the last six. [2:52:21, 2:52:26]: six months within half a mile of that. This is Lakes Bobby and the surrounding communities. [2:52:26, 2:52:41]: Right now, over the last six months, your average sale was over half a million dollars. Currently under contract, eight hundred and seventeen thousand dollars. Now I say that to say National Association of Realtors did a study, it's right here and I'll leave it for you. [2:52:41, 2:52:45]: The number three thing that affects property values down. [2:52:46, 2:52:51]: Is a high concentration of renters and apartments, only worsened by a strip club. [2:52:52, 2:52:55]: Only worsened by a strip club and a bad school. [2:52:56, 2:53:01]: So with that, with eight with with that kind of percentage, you're gonna tell these neighbors [2:53:01, 2:53:11]: that they're gonna lose a hundred thousand dollars in their home ownership. And if you don't believe me, the other agent that does just as much business as I do is sitting right over there. And he does the commun does the community just like I do. [2:53:11, 2:53:24]: On top of that, uh what you need to know is um the average ownership of these kind of developments is three to five years. We know that the first owner is not the problem. It's the second owner, when they don't live by the standards that's been promised. [2:53:25, 2:53:28]: If you go to the website for Tell Us right now, you're gonna see [2:53:28, 2:53:32]: Over half of the ones they that they're touting are not even built. They're conceptual. [2:53:33, 2:53:37]: So I'm I'm not gonna say I know their track record, but I only see conceptual drawings for the most part. [2:53:38, 2:53:41]: Also the road frontage that they're speaking about. [2:53:42, 2:53:48]: Uh if you'll look at the two partials on one thirty eight, they are only going to own the one on the far left side of your screen. [2:53:48, 2:53:56]: The one that's next to their clubhouse, that property owner does not want to sell. I tried to make contact with him and I did speak with him. He is not going to sell to them. [2:53:57, 2:54:03]: He has other plans. And which nobody else has talked about is that property has a residential dwelling. There's a home there. [2:54:04, 2:54:06]: It is currently zoned residential. [2:54:06, 2:54:08]: The neighboring property that goes between the clubhouse [2:54:09, 2:54:12]: And where they're talking about a cut on highway one thirty eight. [2:54:12, 2:54:16]: You need to know there's a home there. So you're gonna tell that homeowner he's about to be surrounded by commercial. [2:54:17, 2:54:25]: Uh on top of all that, uh they are saying at the previous meeting that their uh townhomes was gonna sell for mid-300s. [2:54:25, 2:54:32]: So you're gonna put t three hundred thousand townhomes, three hundred thousand dollar townhomes around eight hundred thousand dollar homes. It doesn't really add up. [2:54:33, 2:54:33]: Um [2:54:34, 2:54:37]: I'll leave it at that for now. Thank you. Thank you. Stop the clock, please. [2:54:49, 2:54:58]: My name is Sherry Bivens. I live at eight one seven three Masters Court, Jonesboro, Georgia, Lakes Bibe subdivision, Lakes Bibe Country Club subdivision. [2:54:59, 2:55:05]: Um, I too am a realtor and everything he said I I I I concur. [2:55:05, 2:55:06]: Um [2:55:08, 2:55:10]: With all due respect. [2:55:10, 2:55:14]: То конгресман Скот, пізнейха'спенраун северотам. [2:55:15, 2:55:16]: He doesn't live. [2:55:16, 2:55:19]: in any of those surrounding communities that are affected. [2:55:21, 2:55:23]: The gentleman that read about the city proclamation [2:55:24, 2:55:25]: being family oriented. [2:55:26, 2:55:26]: Correct. [2:55:27, 2:55:30]: That's why we moved there is because it's family oriented. [2:55:31, 2:55:40]: You made the point that those apartments were going to be one and two-bedroom, meaning single people or whatever. [2:55:40, 2:55:41]: That's not a family. [2:55:42, 2:55:46]: That's not bringing that's not family oriented. That's not bringing the families. [2:55:48, 2:55:49]: Why can't we have [2:55:50, 2:55:57]: A development I mean, like I say, I'm not naive enough to believe that that that land will not be developed. [2:55:57, 2:55:59]: But make it make sense. [2:56:00, 2:56:05]: the the development that's going on that's gonna happen on forty two with the um um [2:56:06, 2:56:13]: a fifty five and older community or w uh I'm I'm sure not sure what they call it fifty five and older assisted living. I don't think it's assisted living though. [2:56:14, 2:56:17]: Why can't i that's that would be comparable. [2:56:17, 2:56:20]: That would be comparable to what's already there. [2:56:21, 2:56:24]: And then Mr. Traylor made the the comment about [2:56:24, 2:56:25]: Um [2:56:26, 2:56:34]: They took a trailer park in Kennesaw and made it a mixed-use complex and how happy Kennesaw was. I be too. [2:56:36, 2:56:42]: I'd be happy if they took a trailer park around here and made a mix mixed complex, use a mixed mixed complex. I would. [2:56:43, 2:56:47]: But why our homes are far from a trailer park. [2:56:47, 2:56:48]: Does [2:56:50, 2:56:50]: I know. [2:56:52, 2:57:01]: Mr Alexander has several times. Point of order, point of order. There's no mentioning of anybody. It has been said. [2:57:02, 2:57:05]: Go ahead, man. That the traffic is not that cannot be [2:57:05, 2:57:07]: Considered when doing when making [2:57:08, 2:57:17]: Traffic needs to be considered. Have you driven down 75? Address me, ma'am. Has anybody driven down 75 any time of day or night? [2:57:18, 2:57:24]: How is that you're putting these apartments right here on 75? We already have a mess. [2:57:24, 2:57:30]: I have people that tell me they don't wanna come down here to visit because they don't wanna get on seventy-five. [2:57:31, 2:57:32]: It is a mess. [2:57:32, 2:57:37]: And to all the people who came and spoke from Eagles Landing and McDonough [2:57:38, 2:57:41]: Let'em put one next door to you and see how you feel. [2:57:42, 2:58:00]: You can't live in this community. So you don't have a say something. Mayor, mayor, point of order. You can't do that at a public hearing. Stamp stand by please. Relax, relax, please. Relax. [2:58:00, 2:58:03]: Ma'am, your time's up. That's fine. [2:58:03, 2:58:05]: Stop the clock, please. [2:58:05, 2:58:06]: Top the clock. [2:58:12, 2:58:13]: Come on up, please. [2:58:14, 2:58:16]: Before we get started, how much time's left on that clock? [2:58:17, 2:58:18]: Okay. [2:58:18, 2:58:20]: There you go. Name and address, please, ma'am. [2:58:20, 2:58:40]: I'm Melissa Kalandro. I am at 358 Emerald Trace, which is in the Lake Spivey community. I've also been on the HOA board there for about seven years. And so I speak not only on my behalf, but of all of the neighbors, some of which are here tonight and some of whom could not be here. [2:58:40, 2:58:52]: Opening comments that that Mr. Payne, I believe is his name, said about the land use that's already approved should be taken into consideration. In the past three months, you guys are looking at [2:58:53, 2:59:05]: proposals of three developments within a couple of miles of each other that each have over three hundred apartments. And I think that um [2:59:06, 2:59:11]: The neighbors, our community does not want this, and you guys need to hear that. Um [2:59:11, 2:59:17]: We want nourish and bloom, that'd be great. Put it in the Spivy Commons empty, you know. [2:59:18, 2:59:22]: Публік спда спеціально синдр ліс фор. [2:59:23, 2:59:29]: Um but that that's all I just wanted to say that that all of these developments together um need to be thought about. [2:59:29, 2:59:31]: Thank you. Dr. Clark. [2:59:35, 2:59:36]: How much time's left? [2:59:37, 2:59:38]: Okay, now [2:59:40, 2:59:46]: Council, there are four individuals left. Hold on, four individuals left. Sixteen seconds says ten minutes time period is up. [2:59:46, 2:59:55]: Are you gonna allow for have a little more spe hold on. Are we gonna allow to have these individuals this tweak, give this one time? Yes. [2:59:55, 3:00:00]: Mm Ma Mayor Purtain, you good? I I'm good. May Mayor Fort, may I say something? Yes, sir go ahead, please sir. [3:00:01, 3:00:08]: Uh I I was I'm in favor of them speaking for sure, but I wanna say to my colleagues [3:00:09, 3:00:28]: Even though some of these things may be out of bound, but I don't want us to get into these confrontations. So I'm just gonna suggest to my councilmate, we have a presiding offer in the mayor. Let the mayor be the presiding officer. If anyone get out of bound, just let the mayor handle. So I'm speaking to my councilmates now. [3:00:29, 3:00:31]: We are all wrong folks. [3:00:31, 3:00:36]: We don't need this. You know, we we will make a decision. [3:00:36, 3:00:39]: But I don't have a problem in hearing. [3:00:40, 3:00:45]: What you have to say and and I understand that, but we do have to make a decision. But [3:00:46, 3:00:54]: The the the the fighting, the arguments and and we just don't need that. Let's all of us just act like grown folks. [3:00:54, 3:01:07]: Thank you. Thank you, sir. Okay, so what we're gonna do, we're gonna put uh temp put reset for ten minutes. Reset for ten minutes, another ten minutes. There are four individuals that are up now. Those four individuals get a chance to talk. All right, and when the time ends, it ends. All right. [3:01:08, 3:01:09]: Name and address, please say, sir. [3:01:10, 3:01:30]: Tim Kobe, 8663, North Shore Drive, Jonesboro. I'll try and be brief and in the spirit that was just proposed. Thank you guys. I'm glad I'm not sitting on that side. However, [3:01:31, 3:01:34]: A lot of people wish you weren't sitting on this side too. [3:01:36, 3:01:42]: I won't be redundant. I'll try to be simple and quick, which is unusual for me. [3:01:44, 3:01:55]: You're talking about three four hundred across the street past last week. You're talking three fifty and if we can buy this parcel. [3:01:56, 3:01:57]: You guys are already [3:01:57, 3:01:58]: Looking at [3:01:59, 3:02:17]: thousand new residents. There's a gentleman talked about, oh, we can have traffic improvement lights. We already need that. Throw another thousand out there. What do you got? Uh there are things that hadn't even been mentioned. [3:02:17, 3:02:18]: Schools. [3:02:18, 3:02:26]: Where the if if this is a family situation, which as was stated earlier, unlikely to be. [3:02:27, 3:02:29]: You're throwing this in the name [3:02:30, 3:02:30]: Um [3:02:31, 3:02:33]: Making the community greater. [3:02:33, 3:02:34]: So detractant. [3:02:35, 3:02:37]: This community including Starkbridge. [3:02:38, 3:02:50]: was and is a family-oriented community, not big time compete with Kennesaw community. It's a family community. [3:02:50, 3:03:04]: I'd like for you to consider that. You live here, you gotta deal with it. There's commercial stuff that would be welcome. It's in one of'em. Thank you. Thank you. [3:03:05, 3:03:06]: Thank you. [3:03:12, 3:03:14]: Stand by please. [3:03:28, 3:03:30]: All right. Name and address please. [3:03:30, 3:03:50]: Uh good evening. My name's Sean Folks, uh twenty-one seventy Emerald Drive, Lakes Byvie, Georgia. I'm the current president of Lakes Bivy Civic Association. I represent the five hundred homes that are half a mile down the road from this. Um if I said that they were upset about this, that would be an understatement. I rate is probably closer. [3:03:50, 3:03:51]: Um [3:03:52, 3:03:58]: The everything that Robert said and everybody else said, you know, I can echo that, but um [3:03:58, 3:04:18]: I was elected to protect the lake and the property values associated with that lake. As he said, five hundred to a million dollars is, you know, average. Um I would ask you guys to do the same and worry about the surrounding areas versus just building something there to build something. [3:04:18, 3:04:38]: Um I guess well it looks good. Uh you you just you have to take into consideration more than just that particular area right there. There's a lot, um, like they all said, there's a lot around there that this will affect. And um, you know, the lake just to the south there, half a mile. [3:04:38, 3:04:48]: mile, uh it's is n is not gonna do uh anything good for the people that have lived there their whole lives. So that's uh that's all I got. Okay, thank you. Appreciate it. [3:04:56, 3:05:04]: Name and address, please. Hello, my name is Robert Delk, and I live at 341 Fern Hill Court, Jonesboro, Georgia. [3:05:04, 3:05:08]: I am de h president of Spybi Ridge. [3:05:11, 3:05:17]: Let me tell you a little something and I'm gonna make this very short. I moved here from New York about five years ago. [3:05:17, 3:05:19]: Вочал пропози. [3:05:19, 3:05:22]: To do right now is just like New York. [3:05:23, 3:05:31]: Doesn't work for me. This is so far in my backyard, I can't pick my wallet out of my back pocket before it hits me. [3:05:32, 3:05:35]: I am literally on spyy road. [3:05:35, 3:05:39]: I'm picking up garbage already out of my car. [3:05:39, 3:05:40]: I'm off that road. [3:05:41, 3:05:47]: It's it's just going downhill and you're not helping by throwing more equations into it. [3:05:48, 3:05:49]: We don't want it. [3:05:50, 3:05:52]: With that, I'll end. [3:05:52, 3:05:52]: Thank you. [3:06:00, 3:06:11]: My name is Jane Lee, five five three Creekstone Drive, Jonesville, Georgia. I'm very simple and I'm gonna be very quick. Um I have four bullet points. I wrote'em down so I wouldn't stumble over myself. [3:06:11, 3:06:13]: I'm all for growth. I think it's great. [3:06:14, 3:06:16]: Right now when I hit the interstate [3:06:17, 3:06:22]: Near my exit, it's already backed up. I understand that you don't use traffic as a decision. Well, we live here. [3:06:23, 3:06:28]: It has to be decision. Are we gonna fly in and drop parachute down into our houses? [3:06:28, 3:06:31]: mean right now interstate the door when I'm coming [3:06:31, 3:06:35]: in from work, I clean houses, I'm all over the place. That's why I look like this. [3:06:35, 3:06:39]: Maybe twenty minutes. It looks like it's bad. It goes pretty quickly. [3:06:39, 3:06:41]: My question to y'all [3:06:41, 3:06:50]: What is an acceptable amount of time from interstate to tour door to get to your house? Is it gonna be an hour on type top of the commute time already? [3:06:50, 3:06:53]: What you tell me what isn't acceptable amount of time. [3:06:54, 3:06:58]: Spotty Dry does not set up for all that traffic. Are you gonna widen it? [3:06:59, 3:07:03]: Tell me what is an acceptable amount of time from interstate to [3:07:03, 3:07:07]: I live in Spivey Glen, tell me,'cause right now it's twenty minutes. That's acceptable. [3:07:08, 3:07:09]: Tell me. [3:07:10, 3:07:11]: Somebody. How about ten? [3:07:12, 3:07:14]: How how are you gonna make it less time? [3:07:15, 3:07:24]: For me to get from the interstate to my house where you've got I'm not sure exactly where you live and how the distance is. But anyway. The interstate to come off of [3:07:24, 3:07:28]: Seventy five, on to one thirty eight. You take her right. Sorry. [3:07:29, 3:07:43]: Then you take a left to go onto Spivey Drive. I'm right there in Spivey Glen. So all I want to know is what is an acceptable amount of time for y'all to think to go from the interstate just to the entrance of Spivey Glen, because it's gonna be just like Spear Road is now. [3:07:43, 3:07:52]: It's going to be worse than that on our road. You're not going to have. I thought, well, maybe I can go around Walt Stevens and come in, but how am I going to get to Walt Stevens? I'm going to parachute in. [3:07:54, 3:07:55]: So [3:07:55, 3:07:57]: You what's gonna happen? [3:07:57, 3:08:15]: With all this growth, you're gonna have everybody selling their houses because now they can't get in and out of'em. Then they're gonna rent them. I guess the investors are gonna buy them. You're gonna have a bigger mess. I'm very simple. I guess I'm selfish. You tell me how long do I have to wait from interstate to the house? An hour on top of a regular commute? [3:08:16, 3:08:17]: That's my concern. [3:08:18, 3:08:25]: How are you going to solve that problem? It's a problem. And that's all I've got. Thank you. But I'd like to know how you're going to solve it. [3:08:25, 3:08:26]: We'll get you an answer later. [3:08:27, 3:08:29]: You gonna get back to me later? I'll get back to you later. [3:08:30, 3:08:31]: Get back to you later, ma'am. [3:08:32, 3:08:37]: Okay, Mr. Ford, I will touch base with you in three days, so I expect to hear from you. All right. [3:08:40, 3:08:41]: I guess it's a good one. [3:08:42, 3:08:44]: That's all the comments. All right. So that ends the public hearing. [3:08:45, 3:08:46]: Yes, ma'am. [3:08:49, 3:08:53]: Yes I did. I called for that in. I've always called go I'll go from my left to the right, I'll call for this in. [3:08:55, 3:08:59]: You you sir you didn't stand up. You didn't stand up at the time. I call I called for [3:09:02, 3:09:05]: Did you sign up already since she needs come on up here and make your comments then? [3:09:13, 3:09:14]: And you s how much is left on a time? [3:09:16, 3:09:17]: All right, go ahead. [3:09:17, 3:09:18]: Name and address. [3:09:21, 3:09:22]: I'm Bruce Smith. [3:09:24, 3:09:25]: Uh stock bridge. [3:09:25, 3:09:27]: three oh two five three [3:09:28, 3:09:29]: My comment is [3:09:30, 3:09:31]: All these people here. [3:09:32, 3:09:33]: Every last one of them. [3:09:34, 3:09:35]: Have said no. [3:09:36, 3:09:39]: And it appears that uh you're gonna say yes anyway. [3:09:40, 3:09:41]: Because if you do [3:09:41, 3:09:46]: I'm gonna tell you now, you've had one council person that's been shooting real hard for this thing. [3:09:47, 3:09:54]: I'm talking to you, uh Mayor Ford. I'm not addressing anybody else. I'm addressing the council and you. [3:09:55, 3:09:58]: You have one council person that's been shooting real hard for this thing. [3:09:59, 3:09:59]: And [3:10:00, 3:10:04]: In my experience in politics in Louisiana, Illinois, and Rad here. [3:10:04, 3:10:06]: This thing smells kind of fishy. [3:10:10, 3:10:10]: All right. [3:10:14, 3:10:14]: No. [3:10:16, 3:10:19]: All of you know me. I was here before you even got up there. [3:10:20, 3:10:22]: Matter of fact, I hope some of you get up there. [3:10:23, 3:10:24]: But guess what? [3:10:24, 3:10:27]: If you approve this thing, I'm gonna do it everything in my power. [3:10:27, 3:10:30]: possible power to get you from up there. [3:10:33, 3:10:34]: No. [3:10:37, 3:10:53]: You had a council member that's around here talking and and this gentleman over here made reference to the amphitheater. M Mr. Smith. Well I I'm I'm I'm just making reference to what he said. Mr. Smith. Address me and you don't need to be. I'm addressing you, sir. Okay. I have not talked to anybody else but you. Okay. You know I love you. [3:10:53, 3:10:56]: So I'm not talking to anybody else. But the point is [3:10:58, 3:11:03]: This project is not gonna put one dime in the city of Stockbridge Revenue, just like that amphitheater. [3:11:05, 3:11:06]: It's not gonna put a dime in the city. [3:11:06, 3:11:11]: All it's gonna do is make somebody rich and I told you smells fishy. [3:11:12, 3:11:16]: And and guess what? It's gonna come out when somebody go fishing for the fish. [3:11:17, 3:11:29]: Now I strongly advise you to take this thing under consideration for your approval. Because some people, Mr. Mayor, have made up their mind already about what they're gonna do. Keep in mind now. [3:11:29, 3:11:31]: No, no, no. [3:11:33, 3:11:34]: No open air. [3:11:41, 3:11:44]: Now, Mr. Mayor, you know I don't play. [3:11:44, 3:11:50]: And I'm not making a threat and I'm not making an intimidation thing like that. But what you're about to do is wrong. [3:11:51, 3:11:52]: Extremely wrong. [3:11:52, 3:11:53]: And if you vote [3:11:53, 3:11:59]: to put this thing in in progress when you got all these taxpaying citizens right behind me. [3:11:59, 3:12:04]: Saying no, then we got a problem. Thank you for your time and believe me. [3:12:12, 3:12:23]: Okay, now the public hearing is over. Okay. Now um council, any additional comments that need to be made before we take a vote? Anybody? Go right ahead, Mr. Blount. [3:12:24, 3:12:28]: I just wanna make a comment before we go into voting. [3:12:30, 3:12:35]: Those that know me know that um I don't know how to be a politician. [3:12:35, 3:12:36]: I don't. [3:12:37, 3:12:40]: But that's my title because I'm an elected official. [3:12:41, 3:12:43]: And one of the things I don't do [3:12:44, 3:12:53]: I don't come here every day or come to City Hall or do my job as an elected official being concerned whether I'm gonna get elected again. [3:12:54, 3:13:03]: I have a beautiful wife, I have a I have a life outside of this. And at any given time when the citizens decide that they don't want a John Blount again, that's what I go to. [3:13:05, 3:13:08]: But I do try to make a sound decision on everything that I do. [3:13:09, 3:13:10]: Everything that I do. [3:13:11, 3:13:15]: I listen to citizens, I do initiatives. [3:13:15, 3:13:20]: And so I listen to you just like I listen to any other citizen. [3:13:20, 3:13:24]: And any decision I make up here, I can only speak for John Blount. [3:13:24, 3:13:37]: I make that decision because it's the decision I feel is best for the city of Stockbridge that I was elected to serve everybody. It's not one community, it's not one street, it's not my community, it's the whole entire city. [3:13:38, 3:13:50]: But I say that to say that we have to be careful when we are so provocative at times that we believe that ever any one person up here stands on the ground that this is the totality of their lives. [3:13:51, 3:13:52]: And it's not. [3:13:52, 3:13:53]: Not mine, [3:13:54, 3:13:57]: So any decision I make tonight, you determine [3:13:57, 3:14:05]: Who I am on whether I'm gonna be elected again. But I don't live to be elected. I be I live to serve. I know how to serve the citizens. [3:14:05, 3:14:09]: And so I would say that I thank you all for showing up like this. [3:14:09, 3:14:20]: Uh if any s it issue or situation come with my community, I wanna I wanna see the showing that you all are doing. I think it's a beautiful thing when citizens come together for a cause that they believe in. [3:14:20, 3:14:22]: So I thank you all for coming. [3:14:22, 3:14:24]: Okay, any other comments from the class? [3:14:28, 3:14:29]: Good evening. [3:14:29, 3:14:31]: Um [3:14:32, 3:14:49]: I heard a lot of comments on in the past whether or not we've made our decision. And I feel as if I wouldn't do my job here if I didn't research and do my due diligence first. I have literally um [3:14:50, 3:15:10]: Whether I've dissected if I could pull social security numbers, I'd will go through every single thing I can in regards to a project of this size and this manner. I think that it's important that all of my colleagues do the same. So by the time we [3:15:10, 3:15:19]: Get up here a lot of times, we do kind of sort of have our minds made up because we've done the research on it, kinda sort of. [3:15:20, 3:15:28]: Not necessarily saying we're 100%, because we do need to listen to our constituents. [3:15:29, 3:15:49]: It's been put out here for uh several uh days, several weeks, several months. And so we've had the opportunity to research and to ask those questions and to express our concerns. Um most recently there was another apartment complex unit. Um it had way more three [3:15:49, 3:16:09]: Three bedroom apartments. It had way more, and it was, you know, a little bit different to me in regards to commercial space. And right now, commercial is very important to our community. And that is because we hear the needs of you. [3:16:09, 3:16:19]: that you want a Trader Joe's, you want uh uh Whole Foods, you want these different things, and we have the opportunity to do something that is the state of the art. [3:16:20, 3:16:40]: And so that perked my interest. Um, please understand uh, you know, I don't take threats lightly. I d I really don't. And I very well have educated myself on this particular [3:16:40, 3:16:53]: project even as the ninth hour right before coming here. So I don't take it lightly at all. And yes, transportation does matter. Roads do matter. Infrastructure matters. [3:16:54, 3:16:55]: Please. [3:16:56, 3:17:07]: No, that every time I consider something, I consider the totality of everything of what I think is in the best interest of Stockbridge. I do believe that this project is a quality project. [3:17:09, 3:17:11]: It is high end. [3:17:11, 3:17:23]: The rent base, the living uh single the the townhomes are very uh I don't want to say very expensive, but they're just as high as our mortgages. [3:17:24, 3:17:30]: In the subdivisions that we live in, and I live on that side of town, I am very passionate about my community. [3:17:32, 3:17:44]: And so I say to you, whether you agree or disagree or be disappointed, that I've done everything I can to make sure that this project is within the best interest of Stockbridge. [3:17:45, 3:17:46]: That's all I have to say. [3:17:47, 3:17:55]: It's a it's uh hold on, man, you had your opportunity No, but you had your opportun ma'am, you had your opportunity to speak. Uh uh [3:17:56, 3:18:03]: Guys, security guys, you take her out of here. You had your opportunity to speak. You already had your opportunity to speak. I gave it the word. [3:18:03, 3:18:07]: See see that's what I'm saying. You're out of order. [3:18:08, 3:18:26]: You're out of order. You're out of order. You already had your opinion. Ow, ma'am, out. Ma'am I wasn't addressing her. You said that. Just stop. Stop. Just hold up. Hold up. [3:18:27, 3:18:32]: Out of here. All right. Now, Council, if you have any other questions, or comments. Ms. Barber, go ahead please. [3:18:44, 3:18:45]: Go ahead, Ms. Barber. [3:18:49, 3:18:52]: Mm-hmm. I hear you all loud and clear. [3:18:53, 3:18:53]: I do. [3:18:57, 3:18:59]: My obligation is to our city. [3:19:00, 3:19:02]: But I want to be neighborly. [3:19:03, 3:19:04]: Which is why I've [3:19:05, 3:19:08]: set up calls with some of your community members. [3:19:09, 3:19:14]: To hear your concerns, to see what it is that I can address. [3:19:14, 3:19:15]: with the developer. [3:19:17, 3:19:19]: We have a responsibility. [3:19:19, 3:19:20]: To grow our city. [3:19:21, 3:19:22]: To do nothing. [3:19:23, 3:19:24]: It's not an option. [3:19:25, 3:19:27]: I'm the newest member of this council. [3:19:29, 3:19:32]: In twenty eighteen, our city faced a unprecedented [3:19:33, 3:19:34]: Piece of legislation. [3:19:35, 3:19:37]: То террасі апарт. [3:19:38, 3:19:40]: by this proposed city of Eagles Landing. [3:19:41, 3:19:50]: What they said was they wanted high-end quality retail stores, restaurants. [3:19:51, 3:19:54]: We've been presented with a proposal. [3:19:55, 3:19:56]: What I represent. [3:19:58, 3:20:00]: Is growth. [3:20:01, 3:20:02]: No. [3:20:02, 3:20:03]: Stockbridge. [3:20:04, 3:20:05]: We have to. [3:20:07, 3:20:08]: I want to be neighborly. [3:20:09, 3:20:11]: I don't wanna be fighting with anybody. [3:20:12, 3:20:13]: This doesn't serve [3:20:14, 3:20:15]: Any of us. [3:20:16, 3:20:24]: Fighting with prop folks who live in Eagles Landing, fighting with those who live in Lake Spivey. [3:20:25, 3:20:27]: We need to make sure that we're taken care of. [3:20:28, 3:20:29]: Our city. [3:20:30, 3:20:30]: Uh [3:20:31, 3:20:32]: Constituents. [3:20:33, 3:20:34]: I've spoken with a number of them. [3:20:35, 3:20:36]: In fact. [3:20:37, 3:20:41]: Two of the individuals who were out in the community with me. [3:20:41, 3:20:45]: During that whole proposed city of Eagles Landing, they're here. [3:20:47, 3:20:50]: This is what we were knocking on doors telling people that we would do. [3:20:52, 3:20:53]: А вони deliver. [3:20:54, 3:20:55]: On every single thing. [3:20:56, 3:20:58]: That I told people that we would do. [3:20:58, 3:20:59]: During that time. [3:21:02, 3:21:03]: That's all. [3:21:04, 3:21:05]: It does not mean that [3:21:06, 3:21:07]: Any decision that I make. [3:21:08, 3:21:09]: is to [3:21:10, 3:21:10]: Um [3:21:12, 3:21:14]: Affect your property values in fact. [3:21:14, 3:21:17]: This is being presented as a luxury development. [3:21:18, 3:21:19]: It's gotta help. [3:21:20, 3:21:23]: Increase камда фур пропаті валіз. [3:21:23, 3:21:26]: Go over to comments. Calm down, please. [3:21:26, 3:21:27]: Our community. [3:21:28, 3:21:29]: Entire community. [3:21:30, 3:21:31]: Highway one hundred and thirty eight. [3:21:31, 3:21:33]: It's a major artery. [3:21:33, 3:21:34]: Of our city. [3:21:34, 3:21:35]: It is a state. [3:21:36, 3:21:36]: Highway. [3:21:37, 3:21:39]: It's not a city road. [3:21:40, 3:21:41]: It's a state highway. [3:21:42, 3:21:45]: We cannot deny a proposed development. [3:21:46, 3:21:47]: Based on a road. [3:21:48, 3:21:50]: It is our responsibility that we plan. [3:21:51, 3:21:52]: For future growth. [3:21:55, 3:21:58]: I lived off Walt Stevens for eighteen years. [3:21:59, 3:22:01]: I bought my first home in Brentwood Park. [3:22:03, 3:22:05]: I know the area very well. [3:22:08, 3:22:11]: All of those corner lots on Highway One Thirty Eight. [3:22:12, 3:22:15]: А метфоделмент. [3:22:17, 3:22:19]: Those that live in that area. [3:22:19, 3:22:22]: have had the convenience of accessing [3:22:22, 3:22:26]: How Highway 138 and I seventy five. [3:22:26, 3:22:27]: In a matter of [3:22:28, 3:22:30]: Five ten minutes. [3:22:30, 3:22:32]: Because there has been no development there. [3:22:35, 3:22:36]: You should know. [3:22:37, 3:22:38]: Еврій конер [3:22:38, 3:22:40]: Of a major highway. [3:22:41, 3:22:43]: There will be a development coming. [3:22:44, 3:22:47]: A proposal that will come to the city. [3:22:49, 3:22:51]: We cannot just not do anything. [3:22:52, 3:22:54]: That's not an option. [3:22:55, 3:22:56]: We have to grow our city. [3:22:57, 3:23:00]: That's what our responsibility and obligation is for. [3:23:01, 3:23:05]: I know many of you here are from Clayton County. [3:23:06, 3:23:09]: I know the Lake's Bible community is Clayton County. [3:23:10, 3:23:11]: Not Henry County. [3:23:12, 3:23:14]: But again, I want to be neighborly. [3:23:15, 3:23:16]: I want us to work together. [3:23:16, 3:23:17]: I don't want to fight with [3:23:18, 3:23:19]: Anybody. [3:23:20, 3:23:24]: А вона девеп і коммуніти да ви кан би про. [3:23:28, 3:23:28]: That's all. [3:23:29, 3:23:37]: All right, council, any other comments? And if not, I need a motion uh to for comprehensive plan amendment case. There's a motion. [3:23:38, 3:23:39]: Yes, sir. [3:23:39, 3:23:59]: So I'd I'd like to make a motion to approve the request uh as presented by staff with the recommendation. I would also like to add that uh we recently passed uh street lighting for the city. And I would like to add to this that we to and suggest that we in my [3:23:59, 3:24:19]: Motion that we add street lighting from I-75 all the way to this development so that there will be plenty of light uh for that development and the safety aspect will be put in place. So when people shop at this development, it would be appropriate. Well let let's how about let's let's let's let's if you let's make a motion just for this. [3:24:19, 3:24:32]: All right, let's just make a motion for approval for the development as recommended by staff. Thank you. Is there a second? Is there a second? Ms. Barber second that. Any further discussion? Yes. Further discussion. Yes. Go ahead, sir. [3:24:35, 3:24:54]: Um, one of the things I wanted to say is that when it comes to this development as the last development that came before us, and anybody that knows me know that I have uh issues with such a large rental piece in any development. [3:24:55, 3:25:15]: And because I know that the rental piece itself eventually becomes the piece that controls the community. It controls the value of the community because it becomes now supply and demand versus supply and uh and whatever level of of uh [3:25:15, 3:25:26]: of um of mortgage or whatever you're gonna pay is there. So I've always had a concern about a high rental piece when it comes to any community. [3:25:27, 3:25:30]: So I'm gonna say this before the vote is taken. [3:25:30, 3:25:33]: That I'm not going to vote for this project, I'm going to abstain. [3:25:34, 3:25:37]: All right. Any other comments before we take the vote? [3:25:37, 3:25:40]: If not, all favor of the a motion please indicate. [3:25:42, 3:25:50]: Okay, all opposed? Oh you are you four, ma'am? So it's four zero one. Motion passed. Thank you very much. Four zero one. [3:25:52, 3:25:53]: I will move on to rezoning case. [3:25:56, 3:26:00]: Resoning case, RZ 2022-04. [3:29:38, 3:29:58]: All right, thank you, Mayor. You're welcome. This proposed project meets one of the main goals of the purpose and intent of the City of Stockbridge Unit Unified Development Code, and that is encourage the most appropriate and best use of land, buildings, and other structures throughout the city. This proposal, in it in its current form, [3:29:58, 3:30:18]: meets the purpose and intent of the UDC. Also, the proposed project can serve as a catalyst for future commercial development in the city. The proposed mixed residential development with townhomes and apartments will represent an acceptable land use transition between the existing single-family detached [3:30:18, 3:30:38]: housing to the east and west, and existing retail uses along Highway 138 West and Mount Zion Parkway. The proposed project does not meet the threshold of a regional development review, and therefore the impacts from the proposed development will be considered acceptable and considerable. [3:30:38, 3:30:57]: considered a normal part of daily living in an urbanized area. However, since the proposed project will be located along a state highway, Georgia DOT and Henry County DOT will be required to be be consulted in the design of the transportation network of the development including ingress and egress. [3:30:57, 3:31:12]: The development the developer will consult with officials from Georgia DOT and Henry County DOT to d to determine whether any road improvements or traffic signalization adjustments needs to be made along Highway 138. [3:31:13, 3:31:33]: The proposed development also meets the purposes of the Parkway Mixed Use Overlay District. The project will feature a balanced mixture of residential densities and proposed commercial uses whereby residents can truly live, work, and play. The proposed development can be a panacea for future economic development activity in the target area. [3:31:34, 3:31:54]: The subject properties as currently zoned are less likely to be developed than in high density mixed use development due to the subject's property location on a state highway because of the Rees Creek tributary and other environmental challenges, and the current lack of pedestrian access for customers who are seeking neighborhood. [3:31:54, 3:32:06]: Retail products and services. The subject property in its current form is less likely to be developed. Only high density development would be feasible at the location because of the challenges associated with the land. [3:32:09, 3:32:29]: The res the rezoning of the subject property to PUD would allow for flexibility in design and greater use of the total site area than the current zoning. As a result, staff recommends approval with conditions. Condition number one: the project will be developed in conformance with the City of Stockbridge Unified Development Code and all. [3:32:29, 3:32:33]: other city code sections regarding site development standards and requirement. [3:32:35, 3:32:36]: The approval of the [3:32:37, 3:32:51]: Of CP twenty two dash o two to change the property's future land use designation from low density vertical to high density re high density residential shall occur simultaneously. [3:32:53, 3:33:05]: Regarding the issuance of land disturbance and building permit, no land disturbance or building permits shall be issued for the subject property until the applicant has combined the twelve parcels, which can be done administratively. [3:33:06, 3:33:06]: Das ist so. [3:33:07, 3:33:09]: Thank you sir, appreciate it. Okay. [3:33:10, 3:33:12]: Council, any questions for uh Mr. Anderson here? [3:33:13, 3:33:15]: Questions, concerns. [3:33:17, 3:33:17]: Good. [3:33:18, 3:33:34]: All right. Once again it's a public hearing. So I open it up. Okay. In reference to this rezoning case. Public hearings open up. Anybody on on this particular side or this uh side here, my left side, uh, do you have any comments for? Comments for. [3:33:35, 3:33:38]: In the middle, anybody for comments four? [3:33:38, 3:33:41]: Once again on the right side, anything comments four. [3:33:42, 3:33:49]: Okay, comments against this particular uh rezoning case on my left side, this very left side, my left side. Anybody? [3:33:50, 3:33:51]: In the middle, anybody? [3:33:53, 3:33:56]: Over to the far right side. Anybody make comments a against? [3:33:57, 3:34:00]: Okay? Come on up, sir. Reset the clock for ten minutes, please. [3:34:04, 3:34:11]: Name and address, please. Uh Mayor Council, uh Robert Payne, 303 Corporate Center Drive, Stockbridge, Georgia. [3:34:11, 3:34:12]: Mm. [3:34:13, 3:34:25]: I heard one of the council members reference that you are concerned about the um the the traffic and and I appreciate that. Um something that is not really being spoken about much here is the fact that look [3:34:26, 3:34:28]: I knew going into this something's gonna go there, it is what it is. [3:34:30, 3:34:31]: But [3:34:32, 3:34:48]: As it stands, the developer does not want to put in an entrance on the piece on the parcel on the far left that has frontage on 138. They've stated to me, and I quote, for us to put in a bridge to get over that floodplain would cost us a million dollars. [3:34:48, 3:34:51]: So the only entrance they're gonna have on one hundred thirty eight [3:34:51, 3:34:53]: is right up against the commercial. [3:34:53, 3:34:54]: So tributary. [3:34:55, 3:34:58]: So folks will have to come down and make a U turn. [3:34:59, 3:34:59]: Mm mm. [3:35:00, 3:35:01]: We all know that that means [3:35:01, 3:35:02]: The majority [3:35:03, 3:35:09]: Of the traffic is coming from I seventy five and I six seventy five is going to turn at Spivey Road. We know this. [3:35:10, 3:35:10]: I'm asking you. [3:35:11, 3:35:13]: You've got to do something about that. [3:35:13, 3:35:19]: It's that road is not built for that. And now that you guys are wanting to annex all of that, it is your responsibility now. [3:35:20, 3:35:22]: You've gotta do something about it. It's dangerous. [3:35:23, 3:35:25]: And now that you're gonna have another [3:35:25, 3:35:29]: I don't know how many, four hundred, let's say, four fifty across the street in one year, guys. [3:35:30, 3:35:34]: You're you're talking of almost a thousand new units in a year, a year and a half. [3:35:35, 3:35:40]: It's not built for it. It's highly dangerous. And cars come flying down. [3:35:41, 3:35:43]: Excuse me, flying down one hundred thirty eight. [3:35:43, 3:35:45]: I think we all know that. [3:35:45, 3:35:48]: Um I I do want to make sure that you know. [3:35:49, 3:35:53]: I've said it before and I'm gonna say it again. The the landowner [3:35:53, 3:35:58]: I was approached by the developer in this to see if I could get that landowner to sell. And I did approach that landowner. [3:35:59, 3:36:00]: They're not gonna sell. [3:36:00, 3:36:04]: Um, I quit talking to the landowner because the developer quit talking to me. [3:36:04, 3:36:05]: Okay. [3:36:05, 3:36:09]: But the landowner has no intention. They're gonna hold on to it and they're gonna find the highest and best use for it. [3:36:10, 3:36:12]: At this point, it's gonna stay like it is. [3:36:12, 3:36:19]: So you you need to know that main entrance is not going to be where you think it's going to be in that cut. It's not going to happen. [3:36:20, 3:36:20]: All right. [3:36:21, 3:36:41]: Um you also need to know, and Mayor, please let if somebody else needs to speak, just Well they've had an opportunity, so right now this uh I'll ask, but go ahead. Yeah, but if if I need to stop you, just tell me, okay, Mayor? Go ahead. Um You you need to know. I I know that we've re that uh the zoning has been done. I get it, okay? But you need to do a couple of things from here on out. [3:36:41, 3:36:41]: Yeah. [3:36:41, 3:36:44]: This developer, you gas [3:36:44, 3:36:49]: I don't want to say ignored, but you guys did not even mention the fact that your planning and zoning board. [3:36:49, 3:36:51]: Did not give support to any of this. [3:36:51, 3:36:52]: Not any of it. [3:36:53, 3:36:54]: They could not vote on it. [3:36:54, 3:36:59]: They they and nobody would motion for this. And you nobody in here brought that up. Nobody. [3:37:01, 3:37:07]: Your planning and zoning board said this is not a good idea at this point. In fact, a conversation was had in the parking lot with your planning and zoning board. [3:37:08, 3:37:09]: That said to the developer. [3:37:10, 3:37:16]: You did not garner the support you needed to get in the spivy community in the surrounding area. You need to get that support. [3:37:18, 3:37:20]: Now I'm I we all know I'm against this. [3:37:20, 3:37:24]: But I said I told the developer, I said, Look, I know something's gonna go there, I get it. [3:37:25, 3:37:28]: So how can we meet in the middle? I'll get you your support. [3:37:29, 3:37:30]: But let's talk. [3:37:31, 3:37:32]: And the developer said [3:37:32, 3:37:35]: You know, the last time we tried to talk it cost us two thousand dollars to have a meeting. [3:37:37, 3:37:39]: And I said, What if I could get you the room for free? [3:37:39, 3:37:44]: And he said, Absolutely, let's do that. I said, I'll get your people there. You guys show up, let's meet. [3:37:45, 3:37:46]: They ghosted me. [3:37:46, 3:37:51]: All right. Nobody had a meeting with me. Or our and then we got a call about [3:37:53, 3:38:04]: four or five days ago that said, uh, we can't make it down there. I tell you what, why don't you and a couple of your uh leaders drive up to the north side of Atlanta and we'll show you our renderings. [3:38:04, 3:38:08]: I don't speak for the spivy community solely. I'm just one vote. I'm one person. [3:38:09, 3:38:12]: It should not require people to have to drive to the north side of Atlanta. [3:38:12, 3:38:13]: To talk to this developer. [3:38:14, 3:38:15]: I think you guys know that. [3:38:16, 3:38:18]: We try to have a meeting with this developer. [3:38:18, 3:38:21]: I had the room set up for free and the developer ignored us. [3:38:23, 3:38:27]: Moving forward, all I'm gonna ask from from you guys is I want you to take into consideration the roads. [3:38:29, 3:38:30]: And all I'm gonna ask you as well. [3:38:31, 3:38:34]: Із вот you approve, I ask and I plead you. [3:38:35, 3:38:40]: Make sure that they sign on to those plans and those designs. [3:38:41, 3:38:44]: You you know that we've had a history, not just Stockbridge. [3:38:44, 3:38:50]: Outside of here as well, where we we agreed on some things with developers and that's not what ends up happening. [3:38:51, 3:38:54]: I plead with you, please make sure whatever you do with them. [3:38:55, 3:39:00]: Make sure that you make them sign on that video that that's what they're gonna build. [3:39:00, 3:39:04]: Because what we have seen habit of I'm not saying this developer, I'm just saying in general. [3:39:05, 3:39:06]: They get it rezoned. [3:39:07, 3:39:10]: They sell it as an option to another developer and they build something else. [3:39:11, 3:39:12]: We've seen it happen. [3:39:13, 3:39:16]: You know, that hotel was sold to you guys is a wonderful deal. [3:39:16, 3:39:17]: And look where it is now. [3:39:18, 3:39:19]: So I'll plead. [3:39:19, 3:39:27]: make sure that you make them sign onto that that that design that that's what's going to be built. Okay? And I appreciate that. No problem. Well noted. Thank you. All right. [3:39:28, 3:39:47]: Thank you. Okay, so there are no other uh individuals against. So I will close the public hearing. And uh any further discussion, counsel before we go on to vote on the rezoning case. Any other comments? Okay, I need a motion uh for uh approval of the rezoning case, please. Sir. Yes, sir. [3:39:47, 3:40:06]: Well I'd like to make a motion for approval as recommended by staff and the plan was always to have the condition included that uh the this development would be reflective of what is presented in the video and the um rendering ad adaptations that were presented to this council. [3:40:07, 3:40:12]: Is there a second emotion? No. I'm sorry. [3:40:13, 3:40:14]: I need to second the motion. [3:40:16, 3:40:17]: I do not have a second emotion. [3:40:18, 3:40:22]: Uh mayor pro temp second emotion. Ms. Barber, you have a do you have a comment? [3:40:22, 3:40:23]: Sure. [3:40:25, 3:40:29]: M hold on, Miss Barber, you have a discussion here? Yeah, discussion. Go right in. [3:40:29, 3:40:49]: Um I wanted to ask in um Councilman Alexander, he mentioned about uh site plans specific as those plans were submitted. But I wanted to also add in addition, any modifications to the slight site plans must be reviewed by staff and brought back to us. [3:40:50, 3:40:52]: For approval. [3:40:53, 3:40:55]: Somewhat a normal process anyway. No. [3:40:56, 3:41:05]: It it shouldn't come back to us. It should the staff should review it. Staff should review it and they've got the city manager you can you can have to approve it. But I want it to be approved. Any modifications. [3:41:05, 3:41:12]: Come on. Not only to be reviewed by staff, but I want it to come back to Council. St stand by, stand by. Ms. Ms. Carter. [3:41:12, 3:41:27]: Uh yes, so all plans that come in before they're approved to be issued a permit do have to be approved by community development. That includes our civil engineer, our building official, our zoning, planning and zoning staff, um, and our fire marshal. So [3:41:27, 3:41:35]: Typically plans do not have to come back to the city council as long as they meet the conditions of zoning for the particular use. [3:41:37, 3:41:43]: Okay. Um Mayor Ford. Yes ma'am. I want to be clear. [3:41:45, 3:41:47]: Any modifications? [3:41:47, 3:41:48]: Whether it be [3:41:49, 3:41:53]: them changing building materials or [3:41:53, 3:41:57]: Not putting shrubbery in a certain area. [3:41:58, 3:42:01]: I not only want staff to review it. [3:42:01, 3:42:05]: I wanted to come back to this council for us to review it as well. [3:42:07, 3:42:10]: I well okay, uh I agree. [3:42:10, 3:42:11]: I do agree with that. [3:42:11, 3:42:31]: I I agree. I want site specific. Um, and I believe that's the term that we were utilized and we had discussions about it before that if there are any changes, anything that's amended, it has to be brought back forth to Mayor and Council. I would prefer it that way, but I also wanted to discuss I didn't know. [3:42:31, 3:42:36]: um that our planning and zoning board denied this. [3:42:36, 3:42:47]: that wasn't discussed. We normally have we just had a meeting any other time, the planning you guys come up and present to us and you let us know. [3:42:48, 3:42:48]: That [3:42:49, 3:42:56]: It's recommended approval by the staff. And then it'll t you'll tell us about the planning and zoning. That didn't happen this time. [3:42:56, 3:42:58]: So it doesn't need to happen again. [3:43:00, 3:43:02]: I have a problem with that. [3:43:02, 3:43:03]: Well, [3:43:04, 3:43:24]: If you're gonna say something, come to the mic. Ms. Carter, go ahead if you want to say something here. So we did state the recommendation. It is on the agenda and in the documents we provided to the city council that was submitted last week. Um but as it pertains to the request to have a condition to require the plans that come [3:43:24, 3:43:28]: come back if modified, that that can be added as as a zoning condition at the will of the council. [3:43:29, 3:43:34]: That seem okay seems to be the will of the council. I'm agreeable to that. [3:43:34, 3:43:40]: All right, so otherwise you will want to now amend my motion your motion to add that in. Yes. [3:43:41, 3:43:54]: Re restate it please, sir. I want to am I want to m uh recommend approval and amend the motion to include the recommendations made by Councilwoman Barber to bring uh those modifications back to the city council. [3:43:55, 3:44:01]: I don't know if Miss Barber wants to you want to second that motion now. Is that Mayor Protein, you good with that? [3:44:01, 3:44:02]: Yeah. [3:44:02, 3:44:05]: Okay, all right. Ms. Barber seconds the motion. All right, further discussion. [3:44:05, 3:44:25]: Yes, ma'am. Go right here, please. One second. Go ahead, please. No, no, go ahead. Um, after looking at this, I want to apologize. You did state that the staff recommends, but I do not hear, I did not hear anything about the planning and zoning board did not approve of this. Um I do uh and I've stated this before. [3:44:25, 3:44:39]: that if the planning and zoning board didn't approve, they're a board that we appointed, I would like to hear from a representative. Maybe we need to make that part of a policy or we can look into that. Have one of them come here and let us know why. [3:44:40, 3:44:43]: That planning and zoning board did not approve. [3:44:44, 3:44:45]: This project [3:44:45, 3:44:49]: We appointed our constituents on a board. [3:44:50, 3:45:10]: To oversee that, we got their opinions of it. And although we have the professional opinions of our of our employees here, we still should consider why did they not approve a project. That's that's something I want to consider in the future. But in regards to this, I'm I'm in agreement with Councilwoman Barber and I'm I'm ready to vote and move forward. So I'm [3:45:10, 3:45:16]: My apologies for that, but it was not stated in regards to what the planning is zoning was not. [3:45:16, 3:45:18]: Mr Blanc, go ahead, please. [3:45:18, 3:45:32]: Yeah, uh and this is also for you, Madam Clerk, uh if you can make documentation that um one of the things I wanted to do uh today was to get some questions answered that I had uh that I needed to have answered. [3:45:32, 3:45:35]: And I was um, you know, due to [3:45:36, 3:45:50]: unforeseen circumstances with staff, I wasn't able to get those things answered. So I couldn't d that's that's the premises of my abstention uh today. Uh and so I just wanted that to be put in the record if you don't mind. [3:45:51, 3:45:51]: Thank you. [3:45:51, 3:46:01]: All right, motions are made and amended and seconded if from Alexander to Councilwoman Barber uh for approval. All favor, please indicate. [3:46:03, 3:46:05]: Can you all oppose? Abstain. [3:46:06, 3:46:13]: Mayor, I'm gonna approve and uh and I would like to see uh I would like to approve and and make a motion. [3:46:13, 3:46:22]: Yes, I'd like to approve. Okay, it's approved. All right. All all five of you approved that. Okay. So But I would I would also like this council, I'd like to make a motion that [3:46:22, 3:46:24]: Because we're doing it for this project. [3:46:25, 3:46:30]: I would like to make a motion that w going forward that we we keep this policy in place. [3:46:30, 3:46:40]: Uh with the policy of of the the adjustment of the Yeah, the any any modifications or changes. Okay I think that's a good uh Well I don't know if well maybe I don't know if you're really emotion. I think we have an under. [3:46:41, 3:46:43]: I think we have an understanding that [3:46:43, 3:47:03]: The the process, I think Miss Carter mentioned that the process would would we change and would add that in there. I believe that's what you said earlier. Right. For this particular case. Okay, this case. Um what we can do is look at look at the UDC again to see what verbiage we have um and make sure that we we include that. We'd have to bring that formally to you all to make that a a amendment. [3:47:03, 3:47:04]: Amen. [3:47:04, 3:47:11]: So is that acceptable first of motion that w whatever happened, whatever needs to happen to put that in place, I think it's a safe [3:47:11, 3:47:31]: Uh i this council did just need has to be informed on what's actually going on and not be blindsided by anything or or when it comes to development or anything pertaining to the city. I just like if there's any changes or modifications, I think it'd be good to the council do know because if there's something that comes from the uh public, from citizens to us, we're aware on how to answer. [3:47:31, 3:47:41]: answer those questions how to direct those citizens, but we can't do that if we're not aware of what those changes are. Uh i if you would [3:47:42, 3:48:02]: A motion has been made, it's been second, but it's been some conversation. Can can we clarify the motion and then I'd see no more. But you're talking about the first one passed, sir. You're talking about the second one that Mr. Blount made, you mean? The first one passed. Okay, so that's passing. Yeah, that passed unanimously. It's another motion. Well he wanted to put a motion on. I didn't know if it's really necessary to do that, but if you want to put a motion on there and do this [3:48:02, 3:48:22]: because conversation if if the second and you want to prove it so be it but you need clarification what the motion is that what you're asking for okay let me let me make sure I hear okay the motion that Mr. Blonde is making make sure that we're clear on that. I just want to let me let me make something clear also. And I'm making a motion because I don't ever want to feel like I'm giving a direct [3:48:22, 3:48:22]: Yeah. [3:48:23, 3:48:31]: If this council approves of a of something, I w I make a motion to do it and it's collectively done. That's the only reason I'm making a motion. I can't tell you that's what I want. [3:48:32, 3:48:34]: Not no one council member should be able to do that. [3:48:35, 3:48:37]: And that's why I'm making a motion that we're in agreement. [3:48:38, 3:48:41]: that going forward any any of the modifications to any [3:48:42, 3:49:02]: thing that's contractual for development that is brought to this council, any modifications that is presented to this council. And that's the only reason I'm point of order. And that's the motion. Yeah. Point of order. What's your point of order, sir? That will require an amended amended to amendment to the agenda to add that item. We've already voted. Well no, your your your your vote, your the vision [3:49:02, 3:49:13]: Right, but in order to add this item to the m agenda, you need you need to add it to the agenda. It's not only the agenda. [3:49:14, 3:49:15]: Mm-hmm. [3:49:15, 3:49:16]: You sit there. [3:49:18, 3:49:23]: Well we needs a lower input. We'll st we'll stand by a second. Mr. Gardner, you're you're coming up. [3:49:26, 3:49:46]: Um, real quick, I think um putting that requirement on every single development would slow development down beyond belief. I think we use this tool only when we know that it's been a contentious issue and if people want to see what actually goes there, goes there. But if we brought every development through this process, [3:49:46, 3:50:06]: As soon as we see something that oh, that something we can't we could negotiate with the the applicant through the pro regular administrative process, y'all have a bunch of stuff on y'all agenda coming as things ratchet up in the city and everything would have to come to you if they do any slight modification. That that's [3:50:06, 3:50:22]: That's not effec efficient. M Mr. Garner, and I and I and I and I I I would have to concur with you to a certain extent, but as you know that we we've had a development that was outside of what uh [3:50:23, 3:50:35]: I don't wanna get too deep into that, but uh w w um I I I I don't wanna come in uh I d because I get out of line, I don't I don't wanna go into that. But but we have to make sure that's that uh um [3:50:35, 3:50:55]: Staff modifications aren't to a point because you have the right to do something is so far out of out of uh out of line of what the council uh is expecting. That's the what I'm trying to prevent. However, we can modify that itself, uh, I think that it should be done. And I agree. Uh don't tell me they putting six brushes, uh six instead of [3:50:55, 3:51:15]: And so I I agree with that. There's not every single modification. So I however you can uh get the verbiage for what I'm trying to say without it being an overbound step, uh I would pull my motion back or or uh until and and you could bring something to us. However we can modify that. Is that uh is that uh [3:51:15, 3:51:29]: Sound like something you can do, Mr. Garner? You you want us to bring back language? Well what I'm what I'm saying is I don't want the I don't want the language to be that you bringing back every single little item to hold up any kind of development. [3:51:30, 3:51:41]: Uh I tell you what, I'm gonna hold it off until we talk uh privately and and and because um it's some issues that I need to let let you know that happen that we need to try to prevent. [3:51:41, 3:52:01]: Okay. So you're withdrawing this motion now. Is that what it is? Well uh yes. Okay, so all right, so for this particular project, you got to march in orders, Ms. Carter, Mr. Ms. Gardner, and reference this particular project. And then the motion's already passed and from from uh and amended with uh uh Mr. Alexander. So and so additional conversation to be a [3:52:01, 3:52:21]: With the city manager in reference to some additional items potentially here. So I understand. Okay, so we're gonna move on. I guess you're released to go sit down now. All right. All right. Now um so that passed. All right. What we have next is uh our recom uh recombination, a plaque case, RC, uh RC. [3:52:21, 3:52:26]: I think I was removed from the agenda. [3:52:27, 3:52:39]: Oh that's right. I'm sorry. No council that's right, you sure did. Thanks excuse me, you're right, you cancel Okay. All right, then we're on a new business then. Uh council consideration to appoint a member of the citywide development authority presented by Mr. Washington. [3:52:52, 3:52:55]: That's right. Okay, that's right. Good point. [3:52:55, 3:53:03]: Hi good evening, Mayor and Council. This is just to appoint Gadston Herndon Woodall the third to the application [3:53:04, 3:53:09]: Calm down folks. We got a meeting going on. Go ahead. Go ahead, Ms. Watson. To the development authority. [3:53:10, 3:53:16]: Downtown Development Authority. And you also have the application under point fourteen in the book notebook. [3:53:18, 3:53:29]: So we have we have one individual that's is is asked has application forward to be added to the city wide uh the citywide development authority. And uh and that individual I for I forgot his name. [3:53:30, 3:53:41]: Gatson Herndon Woodall the third. Okay. So is this something typically I mean is this something we need to take an executor session aside, talk about and then come back out, or is this something you all just want to go ahead and approve at this point? [3:53:41, 3:53:46]: Uh sir, if I could ask you questions. So this is there's one position available and there's one applicant. [3:53:47, 3:54:05]: Yes I'm sorry. So there's nobody else and the owner is the owner of Serafinos. I believe I looked at Eric. Is that correct? That's correct. Yes. Okay, they own the restaurant over on Eagles Landing Parkway in the public school. I know where it is. I got it. I I just think we should go ahead and move on. We have anything? I I would just go ahead and do it. What do y'all think? [3:54:05, 3:54:08]: Okay, one applicant, one position, one applicant. [3:54:08, 3:54:15]: All right. I don't know. So is there a motion to accept this individual at this point or just something discussion we want to talk on the second session first? [3:54:17, 3:54:20]: I may I may imagine to make some motion then, sure. [3:54:22, 3:54:33]: Okay. I'll go ahead and make the motion to move forward with the item recommended. Miss the clerk, uh the information has been vetted. Uh Ms. the clerk, you vetted the information, correct? [3:54:38, 3:54:40]: Okay. All right. Thank you. I make the motion to approve. [3:54:41, 3:54:42]: And what's the next [3:54:42, 3:54:45]: Gatson, Mr. Quentin. [3:54:45, 3:54:48]: Gatson would all the third to the citywide development authority. [3:54:50, 3:54:51]: There are seconds in the motion. [3:54:53, 3:54:55]: Is there a second to the motion? [3:54:56, 3:55:00]: Ms. Barber seconds the motion. Okay. Any further discussion? [3:55:03, 3:55:07]: You said that's seraphfinos, correct? Right. Seraphino's. [3:55:08, 3:55:10]: Which is in the public's complex. [3:55:13, 3:55:17]: Motion has been made in a second. Any further discussion? All in favor of motion, please indicate. [3:55:18, 3:55:19]: Two? [3:55:19, 3:55:20]: Three. All posed? [3:55:21, 3:55:34]: I abstain, I'm not familiar with of okay abstain? Absame to me, maybe uh we usually do this behind closed. That's why I asked the question. But anyway, three zero two, the motion passed. Three zero two, the motion passes. If y'all want to go in a congratulations. [3:55:35, 3:55:52]: Next item, Council consideration approved the renewal of the landscape maintenance services contract with Yellowstone Landscape in the amount of three three hundred twenty-six thousand dollars nine hundred and sixteen. And funding source is of is from the government building department, amphitheater, and police department budget funds. Mr. Aaron, please. [3:55:53, 3:55:55]: Yes, um Mr. Mayor and Council. [3:55:55, 3:56:15]: Coming for you tonight asking for renewal of the landscaping contract with Yellowstone. They have been very responsive, done an excellent job maintaining the city's facilities. This will be the first renewal under the contract. They've been with us for approximately one year. Like I said, they've done an excellent job and always. [3:56:15, 3:56:25]: Been responsible whenever we had some additional requests that keep the sites looking good. So we're asking Mayor and Council to approve the contract renewal. [3:56:25, 3:56:44]: Okay. Thank you. Any questions, Council for uh Mr. Aaron? Yes. For answer. Now Mr. Aaron, I know Yellowstone's responsible for this general area here. Now we had a conversation a couple of weeks ago about this work getting restarted. Tell me how's that gonna work and are they gonna be maintaining it and when is this work gonna get started out here? [3:56:45, 3:57:05]: For East Atlanta Road Widening? Yes. We had a meeting with uh George Power. They're supposed to be, there was an agreement we signed. They're supposed to be within the next two to three weeks, they'll be mobilizing to start work on removing the uh lights and things on East Atlanta and South and North Lee Street so that we can restart the program. [3:57:05, 3:57:25]: The project. Okay, we had that discussion two or three weeks ago. No, sir. We had a well, we had a meeting with George Power a week ago. Okay, all right. Okay. I thought it was a little earlier than that. So we should expect somebody to be out here. Is Yellowstone gonna be maintaining it? Is so who's gonna be maintaining it during this work? They still gonna [3:57:25, 3:57:45]: Yes, sir. The area is cut and maintained over there. One of things over there is really the uh silk fencing, but the site is still being maintained. I'm just saying during the con I mean during the it's g it a lot of times it's o it's not being maintained, it's not being kept. There's weeds and stuff in there. Who's gonna do that to make sure? [3:57:44, 3:57:49]: The site across the street. [3:57:49, 3:58:06]: Are you talking about on East Atlanta where they're where they started where they started the construction? Yes. That's not a part of Yellowstone, but staff public works is maintaining that area. We go in and and cut it. But that's not part of Yellowstone. Okay, that's not a part. So we need to [3:58:07, 3:58:09]: Up that a little bit'cause we just not getting that. [3:58:09, 3:58:10]: Well [3:58:11, 3:58:23]: When we initially before they we had the construction, there was a streetscape there that was being maintained, but the streetscape is no longer there because of the construction to widen the road and add the turning lane. All right, thank you. [3:58:24, 3:58:25]: Mr. Blount, go ahead, please. [3:58:26, 3:58:39]: Mr. Dacius, uh I I just wanna say, you know, a lot of times we, you know, this council we're progressive and we we kind of come down on a lot of st stuff that we see. But I wanna say that uh I've got a couple of calls from citizens within the last [3:58:40, 3:59:00]: the week and a half and some things that uh was tasked for you all to do. Uh they said that you guys jumped right on. They was very pleased. So we I want to thank you for that. And definitely appreciate you guys public works doing what you guys are hired to do. My concern is uh with this uh contract renewal, there's two areas that I'm concerned about. [3:59:00, 3:59:00]: Yeah. [3:59:01, 3:59:06]: Uh one is over the where the old fountain is, is that I know the construction has stopped, but [3:59:06, 3:59:22]: I mean it's becoming an eyesore. Who who's gonna be in in in control of at least at least cutting that foliage that's growing up over there kinda wild until they start construction back up? And the second area is gonna be right here on East Atlanta Road. Uh those Craig Murders are growing up into the wires over there. [3:59:23, 3:59:43]: Well, um I try I try to follow the guidelines that the arborists give us as far as cutting and trimming and things like that. That's part of the contract that they do have a landscape architect and a arborist and I try to follow the recommendation that they provide for trimming those crate myrtles. So So they they like the they like it in the [3:59:43, 3:59:56]: In the uh my understanding in the conversation when we initially met with men is that they trim typically do the trimming in the fall. They're not done during the growing season. That was the information that was provided to us. [3:59:56, 3:59:58]: Now now you you you know we [3:59:59, 4:00:08]: But fa Paul is kinda right here coming, you know. Yeah,'cause it it th they're growing up into the wires what uh my concern is that [4:00:09, 4:00:29]: That the uh Craig Murder's growing into the wires on East Atlanta and then what what about over there by the do they want you to wait on the fall or that one too? Sir, I I'm just trying to follow professional advice. So Well it's not the arbers, I'm talking about the other part. Is is Yellowstone gonna be doing that or our part of works? We have we [4:00:29, 4:00:34]: We have a schedule. They'll present us with a schedule when they'll come out and trim and mow and things of that sort. [4:00:35, 4:00:46]: Well, I'm not talking about the quake murders now,'cause you I I'm clear. I'm talking about a fountain, that that foliage where they stopped the construction is really growing up over there. I'll have staff ad address that. All right, thanks. [4:00:47, 4:00:51]: Any other questions for Mr. Aaron? Mayor Ford. Yes, sir, go ahead, please. [4:00:51, 4:01:04]: Uh just just for understanding, uh Mr. Aaron, and I know with this contract and it's listed all of the sites, but when you just finished talking about trimming [4:01:05, 4:01:14]: The trees, just for my understanding and clarification, we're only talking about the trimming that's identified at these sites. [4:01:15, 4:01:35]: Correct. Nothing outside of no sir. Each each facility has their own schedule of maintenance of what is performed at those sites. From it goes from the the the banner poles to the monuments to the city buildings, all of [4:01:35, 4:01:43]: That has a schedule. So any other sites or any other trimming, that's a whole different conversation. All right. Thank you. Yes. [4:01:44, 4:02:04]: Ms. uh grant do you have some questions? Um no I wanted a motion. Stand by standby standby. Miss Barber go ahead. Sharon I wanted to ask, is this vendor responsible for maintaining the upkeep of amphitheater grounds? Yes, ma'am. Amphitheater is separately, separate, but they maintain that as well. [4:02:04, 4:02:05]: Yeah. [4:02:05, 4:02:11]: It's a separate contract? It's it's a separate budget account for the amphitheater maintenance. [4:02:12, 4:02:15]: But the same contractor does all of the city facilities. [4:02:16, 4:02:17]: Okay. [4:02:18, 4:02:26]: Um okay. I have some concerns that I want to express. I'll discuss with you at another time. Thank you. [4:02:27, 4:02:28]: Ms Gan, go ahead, please. [4:02:28, 4:02:37]: All right, Mirror would like to make a motion to approve the Yellowstone landscape in the amount of three hundred and twenty-six thousand nine hundred and sixteen dollars. [4:02:38, 4:02:43]: There are seconds to the motion. That was you, Mr. Blount. Mr. Blount motion and okay. All in favor, please indicate. [4:02:45, 4:02:49]: Oh p you abstain? I'll p you abstain as well? [4:02:50, 4:02:51]: Okay, well, mayor. [4:02:52, 4:02:55]: Yes, ma'am. I might need after I thought about it, I [4:02:55, 4:02:56]: Um [4:02:57, 4:02:58]: Councilman Alexander's not here. [4:02:59, 4:03:05]: Well yeah, I've I would like to w is he coming in? I I would like to um because I'd I would like to [4:03:08, 4:03:13]: I I'll I'll keep it. I'll keep the contract l as is. I mean I'll keep my vote as is. [4:03:13, 4:03:25]: Uh there's a question. If if if we don't do this tonight, then we don't have a landscape, right? He's not. You're correct. Right. So we don't have a choice. [4:03:26, 4:03:27]: Do you have a choice? [4:03:27, 4:03:37]: Well it i this this contract expires September twenty eighth, I thought. Twenty eighth. So it will expire before the next meeting. Yes. [4:03:37, 4:03:38]: Um [4:03:39, 4:03:40]: Mr. Aaron. [4:03:41, 4:03:45]: I do believe the council approved a new policy. [4:03:46, 4:03:47]: For contracts. [4:03:48, 4:03:50]: You are to bring them to the council. [4:03:51, 4:03:54]: А худан твенти дається прийдуть the expiration date. [4:03:55, 4:03:56]: We know l [4:03:56, 4:03:57]: I will no longer. [4:03:58, 4:03:59]: Make a decision. [4:03:59, 4:04:00]: On a contract. [4:04:01, 4:04:06]: That is nearing the expiration. You give this council. [4:04:06, 4:04:07]: No choice. [4:04:08, 4:04:09]: But to approve it. [4:04:09, 4:04:12]: Otherwise we'll have a lapse in service. [4:04:14, 4:04:17]: I'll say no more. Let me let me let me answer that. [4:04:19, 4:04:29]: Uh, Councilman Barber, legal takes full responsibility because of the anti-lide notice that we've received concerning this. And we had reservations about being able to go forward on this, so we pulled it. [4:04:32, 4:04:32]: Okay. [4:04:34, 4:04:36]: So now we can go forward. [4:04:39, 4:04:43]: I would like to discuss that in executive session. Okay. Well Mayor, I would like to withdraw my motion. [4:04:45, 4:04:46]: Okay, motion's been withdrawn. [4:04:47, 4:05:02]: All right, so um obviously it seemed like this is a zeko session discussion. We may ver we may possibly come out as echo session and make a decision on that mo note, if that's the case. Otherwise, we may be in a sit well we'll s find out. We'll find out. Okay. [4:05:03, 4:05:19]: Mr. Aaron, you may need to have to stay around a little longer here in this aspect uh to uh potentially uh readdress this uh council here. Okay? On that note, um we're we're gonna I guess in a sense we'll take the executive session on that note. But anyway, so uh yes sir. [4:05:20, 4:05:22]: If you if it's counsel wish. [4:05:23, 4:05:24]: Yeah, management can take the note. [4:05:28, 4:05:48]: Alright, well I'll tell you what, I'll discuss that with the city manager. All right, we'll do that. Alright, we'll discuss the city manager, see what he wants to do then. Excuse me. All right, no problem. All right, so um my comments. And my comments are these. Um and it's very I mean, I've been doing this for well over two two and a half years. It deals with, of course, uh the pandemic. We're still in a pandemic to a certain degree here. Uh so once [4:05:48, 4:06:08]: Once again, COVID 19 still exists. There were some variants of a virus there. Once again, Henry County uh health department located at 135 Henry Parkway administers Pfizer and Mederma on uh Monday to Friday, nine AM to eleven thirty PM or one PM to two thirty PM. You can call ahead and make a schedule at four seven zero six six four [4:06:08, 4:06:28]: Once again, 470-664-0005. As well as you can go almost anywhere in the Atlanta metro area, City Stobries, wherever Henry County, and get yourself an actual vaccination, as well as a testing in this aspect for COVID-19. But it is free testing. [4:06:28, 4:06:48]: Destiny at the Red Hawk field, Monday, Wednesday, and Friday. It's located on Henry Parkway as well, Madonna. It's Monday, Wednesday, and Friday, 9 a.m. to 3 p.m. to do that. And we want you to be safe. So noted that the CDC recommends that everybody should get a second booster. If you had a booster, first booster, get a second booster. [4:06:48, 4:07:08]: And uh Johnson Johnson booster as well, if you if you need to do that. And uh the thing of it is is that these boosters are probably routine things that come every every f every year like the flu shot. So we'll see how it goes and see what C D C recommends. And a monkeypox, um if if you're concerned about monkeypox, there's an availability [4:07:08, 4:07:28]: to get a shot to be be uh prepared for that as well. But there are uh un unfortunately individuals in Georgia and Henry County that have have the monkeypox. I don't have the numbers right now, but that does exist and people are getting affected. Not very many, but people are getting affected. I want to turn to another another sombre, another moat uh vote, uh excuse me, another issue that's somewhat somber and that's the [4:07:28, 4:07:48]: 9-11 uh remembrance ceremony that occurred yesterday is our city has an annual event to doing this, remembering the 3,000 plus civilians and public service individuals and military that sacrificed their lives on an attack on the United States uh 21 years ago yesterday. And um so [4:07:48, 4:08:08]: So we gotta continue to keep them in our thoughts and prayers, those families, and let us know that freedom doesn't is not free without sacrifice. And all those individuals have perished. We gotta just make sure we never forget about what uh what they actually sacrificed into for our country in this aspect as well. And I want to thank the and unfortunately I I personally wasn't [4:08:08, 4:08:28]: Wasn't uh available uh for remember ceremony yesterday. So I want to thank Chief Trammer for being involved in that process. Um uh Bishop Breyer, I was involved in that. Our Henry County Sheriff, Reginald Scandard, thank you, sir, for being involved in that process yesterday as well. Um and I believe I saw Representative Holly. [4:08:28, 4:08:48]: And came by to be part of the process, as well as a Stockbridge, our junior RLTC from Stockbridge High School. And I believe Miss Barber was present for that as well. So thank you for being present in that aspect. And so we just make sure that we keep those families and never forget about their sacrifice. [4:08:47, 4:09:07]: On that note, I would move on uh to announcements and um upcoming meeting notes and events. Uh so uh the U Council meeting, 530, second Wednesday of each month, uh City Hall and Levi Meeting Room uh September 14th, Downtown Development Authority meeting at 6 p.m. [4:09:07, 4:09:27]: By way of Zoom, third Tuesday of each month, September 20th. Council consideration to approve the renewal of the landscape maintenance services contract with Yellowstone landscape in amount of three hundred twenty-six thousand dollars, nine hundred and sixteen funding source from government. [4:14:03, 4:14:20]: Government buildings, uh Department of Amphitheater, and Police Department budgeted funds. And this is originally presented by Mr. Aaron. So I need a motion now, Council, to accept this proposal. So moved. Is there a second? Mayor Ford. Sir. Did did we decide to table that or did we? [4:14:21, 4:14:31]: D no my understand. We we we decided to go move move forward and and and have a motion to from Miss Gantt to Mr. Blount. Okay, all favor please indicate. [4:14:32, 4:14:33]: I abstain. [4:14:34, 4:14:37]: Okay. All right with the motion uh motion fails then. [4:14:37, 4:14:41]: So it's two uh two for and zero against and one abstained. [4:14:42, 4:14:42]: Huh? [4:14:42, 4:14:43]: Well. [4:14:43, 4:14:45]: Can can I come in? Well, sure, you can comment. [4:14:48, 4:14:51]: I want to choose my words. Okay. [4:14:52, 4:14:52]: Right. [4:14:57, 4:15:00]: I re I really can't comment. Um [4:15:06, 4:15:06]: Oh. [4:15:08, 4:15:10]: I will withdraw my abstention. Okay. [4:15:12, 4:15:21]: The motion still can't pass. If I if I vote no. The motion won't pass. Mo mo motion won't pass. Cause I can't I personally can't vote unless it's two two tie. So motion won't pass. [4:15:21, 4:15:24]: So are you saying that we have to have them [4:15:25, 4:15:29]: We have to have the majority of the quorum to vote. Well, we have a quorum. [4:15:29, 4:15:42]: All right. And we can let to the attorney again for in reference to this uh on the prevailing s on the prevailing side is going to be much more reconsideration. Some out of the prevailing side has to want to reconsider. [4:15:43, 4:15:45]: Well let me ask you this. [4:15:49, 4:15:53]: If it's a two voted yes and one abstain, then it fails. [4:15:55, 4:15:57]: Why? [4:15:58, 4:16:02]: You need three to vote in affirmative even though the other council members aren't here. [4:16:03, 4:16:08]: That's pretty charged, I think. [4:16:08, 4:16:13]: Okay. So I like to make a motion to reconsider the vote. [4:16:14, 4:16:19]: All right. Okay, motion it's made and seconded. All in favor of the motion to reconsider. [4:16:21, 4:16:30]: Well uh why I well uh what y I got two. Are you voting yeah yes or I I uh abstained initially [4:16:30, 4:16:36]: So I'm not sure if I'm in the affirmative to be able to even vote on this reconsideration. [4:16:37, 4:16:40]: So Miss Gantt, what what is what is your intention? [4:16:41, 4:16:44]: Ве, анту деніт. [4:16:44, 4:16:49]: You do not want to deny it. Um I think that [4:16:51, 4:17:08]: what we've understood based off of uh the discussions we don't have anyone doing the service. That we don't have anyone doing the service and that we i it's not uh you know, that it's okay to continue that service. And it expires this contract expires over this month. [4:17:09, 4:17:12]: Yes. So we don't have it's pretty much we [4:17:16, 4:17:18]: There was no no um. [4:17:19, 4:17:36]: Yeah, right. You have become a now so I'm my uh uh Mr Washington, my my understanding for reconsidering if this reconsideration motion was made and so it uh there we have a quorum and so it takes uh to reconsider it takes two or does it take three to reconsider the motion. [4:17:37, 4:17:38]: Okay. [4:17:39, 4:17:42]: Uh y'all put me in a bad situation. [4:17:42, 4:17:46]: And I'll I'll just say this and then I'm I'll change my vote. [4:17:48, 4:17:53]: Okay, so I'm let me just say this now. I I raised some issues as you all know. [4:17:53, 4:17:55]: Uh before [4:17:55, 4:18:00]: And and that's sort of my reasoning. Um [4:18:01, 4:18:06]: I I can't elaborate on what I mentioned before. Okay. [4:18:06, 4:18:07]: Um [4:18:09, 4:18:12]: But I do understand and I do recognize that we do need [4:18:13, 4:18:33]: The services. Right. And that's why I think, you know, it should have been brought before now. Okay. And I think we could have dealt with it. But see now at this late date it's sort of we're in sort of a predicament because after this month and we don't have anyone doing the services, then so sort of where are we? And then we got to put [4:18:33, 4:18:34]: Put this back out. [4:18:34, 4:18:43]: So just based on that then I'll just go ahead and and vote in the affirmative. Okay, well let's see. So we have reconsider. So first of all reconsider, vote for reconsideration. [4:18:44, 4:18:45]: Vote for reconsideration. [4:18:46, 4:18:49]: Mm-hmm. The motion was made May second, so vote for reconsideration. [4:18:49, 4:19:09]: All in favor? Okay. All in favor. Got three votes. Now the motion is to accept this make a motion to accept this particular uh proposal uh for three hundred twenty nine thousand and uh what is it? Nine hundred s I've got now I gotta find the right thing again. What what is it what is it? [4:19:09, 4:19:10]: [15551.4, 15555.0]: Okay, right. Okay for for that's dealing with Yellowstone. [4:19:15, 4:19:16]: And you made a mo you wanna make a motion again? [4:19:17, 4:19:24]: I made a motion to approve that. Okay. And there's a second. Mr. Blount second. All in favor, please indicate. [4:19:24, 4:19:31]: Okay, now the motion passed. Okay, now on that note, great. And on that, now I need a motion to adjourn our council meeting. So moved. So second.
