So [0:02:14, 0:02:34]: And of course due to, you know, of course we had the pandemic, so we're on Zoom, as well as a whole different subject there. And then we come back in the council might start. So we're live, okay. So what I'm gonna do because of the time that we have this proclamation and and one other representative, Dr. Martin Luther King today. [0:02:33, 0:02:53]: So um I don't chief, I don't know if you and your command staff or you and everybody might come on up, but I'm only gonna read a proclamation. I have individuals up here with me and I'll read it and then we'll have words of wisdom from those uh individuals. So once you come on up, right? And uh [0:02:53, 0:03:01]: We're being recorded both sides of the trees, so we're on one side and kind of bounced up a little bit. [0:03:05, 0:03:12]: Summer is finished. Uh one and G. All right, one okay. [0:03:13, 0:03:33]: So what this is, ladies and gentlemen, this is a proclamation from the city of Stockbridge and Recognition of Law Enforcement Appreciation Day. Whereas across the country on January 9th of each year, citizens are partnering with organizations that take the lead to show support on National Law Enforcement Appreciation Day, LED. LEAD, excuse me. [0:03:33, 0:03:53]: And whereas National Law Enforcement Appreciation Day was created by multiple organizations in 2015 to express their gratitude for officers in the United States and support their services for citizens who are encouraged to do their part in thanking the law enforcers on this day, who has law enforcement officers of every rank and file. [0:03:53, 0:04:13]: Chosen profession that puts their life on the line every day for their communities, knowing that they may face extremely dangerous situations. Whereas National Law Enforcement Day is an opportunity to say thank you to our city of Stockbridge police officers, our Henry County Police Officers, the Sheriff's Office, and all the law enforcement officers across the state. [0:04:13, 0:04:33]: Of Georgia and the nation to make the sacrifice to protect and serve. This is a difficult job to do in and of itself, and without the support of the elected body and the rest of the city staff would make our job extremely difficult. So the fact that you all spearheaded this endeavor to provide quality service for the citizens of this great city and your support of our [0:06:04, 0:06:24]: organization, our department is a big reason why many of the folks that are standing here before us today elected to be part of this organization. We have seen in a lot of cities a call to defund law enforcement. This has been a city that's made it clear and especially you that law enforcement is a priority in this community and that you fully support the men and women's department. And you ladies have anything you need you need to say before we all sit out? Oh, they want to make it social fine. How about it? Well, we just want to say thank you this evening for entrusting us with the youth of Stockbridge, and we hope that we make you proud. And we ask and solicit your your support for the youth council. So we always [1:08:00, 1:08:11]: always looking for volunteers and again we say thank you on this evening. Okay, good deal. Thank you. Thank you. All right. Appreciate it. Okay. Good deal. [1:08:27, 1:08:31]: Man, it is. It's tough out there. Congratulations. [1:08:34, 1:08:39]: Uh thank you. [1:08:40, 1:09:00]: Right, ladies and gentlemen, that's the basically the end of our ceremonial portion for this evening. And typically on the first day of our meeting in every calendar year, we go through this whole process of appointments and and uh swearing in of new members of our boards and committees. And I look forward to um more appointments to to a [1:08:59, 1:09:19]: occur, especially since we recently annexed officially as of one January, roughly just under 7,000 new s uh residents in the city of Stockbridge. So hopefully those individuals will see interest and a need to volunteer their time on one of the many boards that we have and uh and so they'll have an opportunity to serve and get sworn in and serve in the community as well. [1:09:19, 1:09:38]: Well earlier today, uh which is only roughly half an hour prior to the start of the meeting, there are two proclamations uh that I have read. And uh the two proclamations uh dealt with, first of all, law enforcement appreciation day, and uh Chief Tremor along with his command staff were in the council chambers here. [1:09:38, 1:09:48]: for the reading of that and accepting of that and also any comments comments that the chief made. And we were able to uh tape that so it's all on uh it's all on tape in this aspect as well. [1:09:48, 1:10:08]: And besides that, uh the next proclamation that was read right before our meeting was um Dr. Martin Luther King Jr. uh day, holiday, of course, which is officially on the sixteenth, which is Monday. And of course, it's we're spe especially proud in the city of Stockbridge to read the proclamation and honor uh Doctor King simply because w without a doubt, [1:10:08, 1:10:11]: [4212.1, 4232.1]: uh uh family, historical home, I should say, of the King family. And and that is due to the fact that uh Martin Luther King Sr., which is known as Daddy King, was initially born at Starp Ridge, raised here, gave his first sermon at age fifteen at Floyd Chapel Baptist Church, which is really less than a quarter mile from this location, and before he decided [1:10:32, 1:10:43]: to go to Atlanta and link up uh with the Ebenezer Baptist Church and find his wife and raise his family. So we're extremely proud about that. Though those proclamations were read earlier this evening. [1:10:44, 1:10:56]: On that note, we will move on with our agenda. And by virtue of the amendment to the agenda, we are actually going to have item number uh originally was 21 move up now. [1:10:56, 1:11:00]: And uh that item dealt with the council consideration to ratify [1:11:00, 1:11:02]: uh the resolution to extend [1:11:03, 1:11:17]: a consultant contract to Harold Young effectively won January twenty twenty three. And I know Mr. Young is here with several members of his team, but this is going to be presented by Mr Our Attorney, Mr. Quentin Washington, please. [1:11:20, 1:11:30]: the mayor council the consultant contract that we discussed is there it is my understanding that the only part that will be changed is the parking setting concessions [1:11:34, 1:11:44]: My understanding is the only part of this contract that's going to be ch that's going to change is the part concerning the concessions. And it's going to be that the city would get a vendor fee. [1:11:44, 1:12:04]: From the concessions and my understanding from talking with the acting city manager and with Mr. Young is that that number is going to be decided based on an average that they're compiling right now from prior concession sales of past the past vendor to be able to come back and bring that number to you. [1:12:04, 1:12:08]: you to set that number for what the rent would be. [1:12:09, 1:12:19]: Oh thank you. Now uh counselor if you've got any questions obviously we can talk about that. Mayor Pro Tem you have any additional things you would like to say at this time, sir? I'll start with you. Go ahead, please. Um [1:12:23, 1:12:26]: I move to approve [1:12:27, 1:12:31]: The contract with three modifications. [1:12:33, 1:12:36]: And if I may, I will read those uh into the record. [1:12:38, 1:12:41]: Number one and I will madam clerk read them a little slow. [1:12:42, 1:12:50]: Uh um the first modification to the document that we have vetted. [1:12:51, 1:12:53]: The city shall receive [1:12:55, 1:12:59]: One hundred percent of food and beverage sales and that is to be changed. [1:12:59, 1:13:00]: Two [1:13:01, 1:13:03]: The city shall reci. [1:13:04, 1:13:05]: One hundred percent [1:13:06, 1:13:07]: of the concession [1:13:07, 1:13:09]: Vendors rent. [1:13:09, 1:13:13]: For all food and beverage sales. [1:13:15, 1:13:16]: Number two modification. [1:13:19, 1:13:20]: The signature [1:13:21, 1:13:23]: On all documents. [1:13:24, 1:13:26]: Where it states the city of Stockbridge [1:13:27, 1:13:29]: Would now be changed to [1:13:30, 1:13:31]: The mayor. [1:13:32, 1:13:34]: For his signature. [1:13:35, 1:13:38]: And number three, and the final modification. [1:13:39, 1:13:41]: is in exhibit a [1:13:43, 1:13:44]: Line five. [1:13:45, 1:13:46]: Promotions. [1:15:27, 1:15:28]: Reference to the resolution. [1:15:30, 1:15:36]: One. This is the resolution to adopt the the independent contractor status of Mr. Young? Right, that is correct. That is correct. Uh I'm very excited. [1:20:29, 1:20:31]: About the future. [1:20:31, 1:20:32]: Um [1:20:33, 1:20:40]: Harold, uh you know how we sort of feel about you. Uh we appreciate you being able to assemble [1:20:40, 1:20:42]: Uh this kind of a team. [1:20:42, 1:20:46]: to move the city of Stockbridge forward, the amphitheater. [1:20:46, 1:20:47]: So and [1:20:48, 1:20:53]: If you guys don't know me, Harold knows, so my expectations. [1:20:54, 1:20:55]: Are always high. [1:20:56, 1:20:58]: And I do feel that [1:20:58, 1:21:03]: My confidence in mister Young, what I have seen, his history. [1:21:03, 1:21:05]: I know he is dedicated. [1:21:29, 1:21:30]: Two hip. [1:21:30, 1:21:31]: Uh [1:21:32, 1:21:33]: To move this city forward. [1:21:34, 1:21:54]: Thank you and welcome to the team of Stockbridge. All right. Outstanding, outstanding. Out of time. Wait a second, please. So the Honorable Mayor and all of the council members uh bid you hello from all the way from Marietta, Georgia. So um I actually um was talking with Mr. Young and one of the things that [1:21:54, 1:22:14]: was a deal breaker in order for me to even do this was that I needed to have enough gas money in order for me to get here each and every time that we have a concert because of the price of gas right now. And I want you to know that the comedy in which I'm going to be doing on stage and also in hosting and being very professional. I don't do a lot of cursing or anything like that. There won't be any cursing [1:22:14, 1:22:34]: 'Cause hell, this city has enough cussing as it is. So I know damn well that you don't want any more. Thank you. Outstanding. Outstanding. Happy New Year, gentlemen, and I've t we look forward to an o outstanding season. I know it's gonna be just great, fantastic, and we're gonna envy and the folks are gonna envy what we got going on down in the South Side. Yes, sir. [1:22:34, 1:22:54]: Mm you ask UAS. Mr. Young, I I I thank you all for coming on and um definitely looking for a great year. And whatever methodically that you guys have to do and move about just as long as you guys communicate with this council that we're all in on one accord and we're all moving the same way, that we don't compromise anything, that everything goes off the way it needs to go off and uh [1:22:54, 1:23:03]: You know, I'm I'm excited about the year and everybody uh on board'cause uh this year would definitely be the anomaly to what we need to be doing toward the future. Thank you. [1:23:03, 1:23:06]: Okay, fantastic. Any other guest ma'am, go ahead, please. [1:23:06, 1:23:26]: I wanted to ask um regarding sponsorship, not specifically who you've um secured so far, but I believe this gentleman is the one from the Urban League. Um can you tell me what your approach is? It's important to me for for sponsorships to secure as many. [1:23:26, 1:23:46]: As we can. What approach have you taken, or is that excuse me for a second? Okay. Has it been indicated to me that this is something probably we should not start discuss at this time frame in open public meetings? Something that would have to be done in more or less a closed session because you're dealing with the this type of sponsorship. So if you don't mind though, I asked for the approach. I didn't ask for [1:23:46, 1:23:55]: for packaging, I didn't ask for the levels, I didn't ask for specifics. Okay. The concept of the approach of how the process would go. [1:23:56, 1:23:58]: Approach us is a process in this aspect. [1:23:58, 1:23:58]: Good. [1:23:59, 1:24:02]: All right. All right. If you can do that, sir, that'd be fine. [1:24:03, 1:24:23]: Go ahead. Yeah, go ahead. Yeah, go ahead. Go ahead. Um, I I think like with anything, um, first thing you want to do is look at past history, um, what what organizations, what corporations have supported in the past. Uh renewals are always um the first place that you want to start. Um then you also look at the uh demographics, the people who um came to concerts on the [1:24:23, 1:24:43]: Last year. And then you try to find companies, corporations that match those demographics. That would be a very appealing from that perspective. So it starts off with a lot of research, number one. And you try to find the fits that will work in terms of the demographics of the city, the demographic of the participants, and also try to capture what [1:24:43, 1:24:57]: will meet their needs in terms of what they're looking for. So that's a very general concept, but that's the foundational basis of the way we would go. If you'd like to get more in depth, uh, you know, I can do that at another time if you in a closed session. [1:24:58, 1:24:59]: I will thank you. [1:25:00, 1:25:01]: Ms. Gann, do you have something else? [1:25:01, 1:25:21]: Well, just that um uh congratulations and thank you. I'm sure you guys are gonna do a phenomenal job. Um I look forward to working with you. I'm glad you guys are part of our family here in Stockbridge. Um in regards to sponsorship, I would hope that we look locally. Um there are quite a [1:25:21, 1:25:37]: few companies that have reached out to um even myself that are local that would love to be considered first. Exactly. Prior. And that and that's really important um to me. But um thank you guys for being here and I look forward to seeing you. [1:25:37, 1:25:57]: If everyone that way we can approach them because we don't we're not aware of those. Okay, good deal. We'll do that. Absolutely. Thank you. Thank you, gentlemen. Appreciate it. Happy new year to you. We look forward to a fantastic year this year. Thank you very much. Good deal. Appreciate you being here. All right. What we have next is actually our public hearings. We have several public hearings. [1:25:57, 1:26:17]: public hearings and the first public hearing deals with the annexation case AX-2022-01. The City of Stockbridge Planning Commission and the City of Stockbridge Mayor City Council will hear an annexation request by S3 Capital Investments LLC. The applicant represented by battle law P [1:26:17, 1:26:35]: The agent to annex a parcel as described below into the city stopbridge city limits upon incorporated uh from incorporated Henry County in order to allow the parcel to be combined with an adjacent parcel for an uh uh ages restricted res residential development. [1:26:36, 1:26:56]: Parcel number 071-01034012. Subject property is an unincorporated Henry County with the frontage of Highway 42 North across from Summit View Drive. Currently zoned MU mixed use with a land uh with a land use designation of mixed M I X mixed use. [1:26:56, 1:27:03]: use gonna contains twenty plus or so acres located in land lot thirty one of district seven. [1:27:04, 1:27:07]: Uh, the planning staff recommends the approval of this request. [1:27:07, 1:27:13]: with a twenty four month well excuse me with twenty four conditions on august twenty fifth, twenty twenty two. [1:27:13, 1:27:18]: The planning commission recommended approval of this request. The city council postponed their vote. [1:27:18, 1:27:25]: on this item until january ninth, twenty twenty three meeting in order to await the decision of the Henry County Board of Commissioners. [1:27:25, 1:27:26]: Who offered an objection [1:27:27, 1:27:28]: To the anglication. [1:27:28, 1:27:42]: However, at the November 14, 2022 Henry County Board of Commissioners, Henry County rescinded the objection, which allowed the city council to render a final decision on the annexation and accompanying zoning request for this proposed project. [1:27:43, 1:27:53]: And Ryan, Mr. Anderson, please. All right, thank you, Mayor. Um on August twenty fifth, two thousand twenty two, the Planning Commission unanimous unanimously approved this item. [1:28:00, 1:28:03]: As you can see here's a aerial topo of the site. [1:28:04, 1:28:07]: Located at twenty-one twenty-five highway forty-two north. [1:28:08, 1:28:09]: Um [1:28:12, 1:28:19]: Background information, the applicant is proposing to to develop an independent living, age restricted residential development. [1:28:20, 1:28:40]: The site address once again is 1225 Highway 42 North across from Summit View Drive and Highway 42 North at Technology Parkway. The parcel is currently located in unincorporated Herring County. The parcel size contains 20.01 acres. The applicant is S3 Capital Investments. The owner is Southern Credit. [1:28:40, 1:28:53]: Rehabilitation and retirement community. The current county zone is MU, which stands for mixed use. The current city zone is none yet. The county land use designation is MIX, which stands for mixed use. [1:28:53, 1:29:13]: And the current use of the properties is the Southern Crescent Rehabilitation and Retirement Center. The surrounding land uses to the north, you got vacant land. South and west, you got Magnolia's at Eagles Landing Subdivision. East you got an industrial warehouse and highlands at Eagles Landing Subdivision. And the Summit at Eagles Landing Subdivision and a Thai restaurant. [1:29:16, 1:29:17]: Um [1:29:18, 1:29:38]: This applicant also has a has has applied for a comprehensive plan amendment and a rezoning application. The applicant would also need to, after successful annexation, he would also need to recombine the two parcels into one, and that can be done administratively by community development staff. There's a stream, a small stream borders the property. [1:29:38, 1:29:41]: To the north, it appears to be a tributary of Wolf Creek. [1:29:44, 1:30:04]: Uh once again I go with the the project description. There's two there's there are two tracts of land like I previously mentioned. Tract one would include the existing Southern Crescent Rehab and Retirement Center and the construction of a hundred new independent living units, including seven detached units and 93 attached units with a density rate of five units per acre. [1:30:04, 1:30:24]: Track two, which is currently vacant, will feature the construction of 176 independent living units, including 52 detached units and 124 attached units with a density of eight units per acre. The total development, including both parcels, will contain 276 independent living units with a density of 6.5. [1:30:24, 1:30:26]: point six units per acre. [1:30:29, 1:30:32]: Uh amenities. Each track would have its own set of amenities. [1:30:35, 1:30:39]: Here's a copy of the uh on the screen is a copy of the boundary survey. [1:30:43, 1:30:45]: Here's a copy of Henry County zoning map. [1:30:47, 1:30:47]: It's current [1:30:50, 1:31:01]: Here's the land use designation map from Henry County. And uh on the screen now is a rendering, well not a rendering, but actually the concept site plan and the layout. [1:31:02, 1:31:06]: Uh right here is a rendering of the of the units and what they will look like. [1:31:14, 1:31:34]: Um and analysis of requests. The subject property is contiguous with this with the city to the north, which be which be which would be combined with the subject property to form the overall proposed development. Water and sewer services are provided by Heron County Water Authority. Fire and EMS services are provided by Heron County. Electricity is provided by Georgia Power. [1:31:34, 1:31:54]: Power Company. Police services are currently provided by Henry County, but this would change to the city of Star Stockbridge if the annexation is successful. The applicant proposed proposes to maintain the existing rehabilitation and rehab facility and to construct 100 independent units on the subject property. Consistency with the city [1:31:54, 1:32:14]: City's company. The subject property is located outside the city. It has a Henry County land use designation of MIX mixed use. The adjacent tract to the north, which will be combined with the subject property for the proposed development, has a land use designation of low density residential and light industrial. Although the applicants propose [1:32:14, 1:32:27]: Comprehensive plan amendment on this of the subject property to high density res residential would not be compatible with these designations. The applicant also seeks to change the land use designation of Track Two to High Density Residential. [1:32:28, 1:32:47]: the positive effects of this d proposed uh annexation. The developer will m maintain will maintain the existing Creston Center Rehabilitation and Rehabilitation Center since many of the proposed residential units will be located to the rear of this facility or the at the end of Technology Parkway. [1:32:49, 1:33:09]: The proposed development may not be visible from Highway 42. Impact on adjacent property owners. To the south and west of the subject property lies the Magnolia Eagles Landing subdivision, which appears to be fully developed. The proposed residential units will be near the lots in that subdivision, but a significant buffer is shown on the site plan. [1:33:09, 1:33:13]: It may be prudent for a developer to also install a fence along the perimeter of the property. [1:33:14, 1:33:27]: uh impact on city infrastructure. A letter from Herman County Water Authority dated March 23rd, 2022, stated that water service, sewage treatment, and sewer line capacity are all available for the subject property. [1:33:28, 1:33:48]: Uh traffic and transportation impact. The developer should coordinate with Henry County DOT and Georgia DOT regarding possible intersection improvements at Highway 42 North and Technology Drive. The city fire marshal approved the proposed new entrance of Highway 42 and the internal site circulation. A deceleration [1:33:48, 1:33:49]: Yeah. [1:33:55, 1:34:07]: Potential environmental impacts. The developer will need to coordinate with city engineers and other environmental officials regarding a bridge crossing over the existing lake, as well as protection of sensitive floodplains. [1:34:08, 1:34:28]: Staff recommendation. The proposed annexation is reasonable in view of the following. The applicant plans to include the subject parcel with the adjacent parcel for a proposed independent living, age-restricted development, traversing both parcels, the surrounding land use and conditions, and the satisfactory finding of. [1:34:28, 1:34:41]: the analysis criteria above. The community development staff therefore recommends approval of AX 202201 for the annexation of the subject property at 2125 Highway 42 North into the City of Stockbridge limits. [1:34:42, 1:34:43]: That's it. [1:34:43, 1:34:49]: Thank you, Mr. Ryan. Appreciate that. Council, any questions for Ryan at all? Questions, concerns? [1:34:51, 1:35:10]: Okay. If there are none, then this is a public hearing uh in this aspect. Uh so I need to open it up in public hearing. So any comments? Sir. Um yes. Point of order. The applicant needs to uh is given an opportunity to make a presentation. All right, we can do that. Que wait Miss Battle. [1:35:10, 1:35:13]: Use my PowerPoint um thing that I said over. [1:35:14, 1:35:34]: Okay, we're gonna roll with what staff here's has here today. I sent over my PowerPoint, but it didn't appear to get here. Um, no problem. I just tried to resend it too, just in case. Um Michelle Battle with Battle Law, 3562, Habersham at North Lake, Tucker, Georgia. Um, we are extremely excited about. [1:35:34, 1:35:54]: This proposed project. I don't want to be redundant with what staff has um already indicated. We really just want to be here to answer questions. Um but um Dr. Sowie uh and his son are here this evening. Um they have been working on this particular um proposal for quite some time. Uh they originally um sought from [1:35:54, 1:36:02]: Henry County to rezone the property that is currently in Henry County, well, that that we're trying to annex in to the city. [1:36:02, 1:36:22]: Um they rezoned that um for the first what I would call phase one of the project, where we had a hundred units that will be age-restricted, that would be adjacent to their traumatic brain injury facility. And the intent here was to allow not only for um independent. [1:36:22, 1:36:42]: Seniors to live within this community, but also for those who may be in the traumatic brain facility, that they might be able to transition out and have some space there to make their transition back into a routine, something pleasant for them. [1:36:42, 1:37:02]: because a lot of people when they come out of the facility may not have a place to go or someplace nearby that would allow them to transition back into everyday life. And so we thought that this was an excellent opportunity for that type of a facility, but also to provide much needed housing for seniors. [1:37:02, 1:37:17]: As you know, that um the senior population is one of the fastest growing populations because of the baby boomers aging. Um and there's a lot of push to have age-restricted communities. Um this annexation. [1:37:17, 1:37:37]: It's very timely from our perspective. If you um have been watching the news, the city uh the county uh just put in a moratorium on um all multifamily townhome and uh uh duplexes. And that means that if we stayed in the county, we would not be able to even put in for a building. [1:37:37, 1:37:57]: Permit on this application, even though it's already zoned for over a year. And so that would just stall out this great need for senior housing because we do have the townhome component mixed with single-family detached units as well. And so this very holistic approach to providing. [1:37:57, 1:38:17]: Senior housing allows people not only to go in as an independent senior, but also there's an aspect of assisted living by having the traumatic brain injury facility there that really will allow people to stay there and age in place because they will have the opportunity to utilize services if needed on an emergency basis. [1:38:17, 1:38:37]: Particularly for those who don't that didn't come through the traumatic brain injury facility, but would have access to the medical staff there if they had some type of emergency. The site itself will have two different community facilities that will both have pools and [1:38:37, 1:38:57]: Cabana, a lot of opportunity for community, and we'll also provide a great amenity package with trails, walkability, all of those things will be present on the site. So we're really excited about the project. We hope that you all are excited about the project. [1:38:57, 1:39:17]: And we are here to answer any questions that you may have. Mayor. Yeah, go ahead, please. Yes, uh thank you, Ms. Battle, for coming forward. I think, you know, in the previous discussion that we had had for all transparency, uh, this was something that we really thought was important for the community because as you indicated that senior house [1:39:17, 1:39:37]: Housing was something that uh there's a dearth of in the in the area and in the community, and I get that phone call on a regular basis. What uh what are we gonna do for the seniors? And it's an age-restricted uh community. Now I do understand that uh Henry County withdrew their objection, but they tried it to. [1:39:37, 1:39:57]: To uh impose some conditions which they really couldn't there was really nothing that they could do to stop the uh uh annexation. Are you trying to adhere by those? So um we have spoken with staff um with regards to that. Um the conditions there are 19 conditions that staff has proposed um that are [1:39:57, 1:40:17]: Consistent with what was proposed by Henry County. There are a few minor tweaks that we have discussed making to those because they don't reflect the totality of the project. They were very specific, sorry, very specific to just the hundred units that were in Henry County and that really. [1:40:17, 1:40:37]: really does not cover um the entire project. So there were a couple of conditions um that we did need uh to make some modifications to and I believe staff is supportive of those changes. And I'm not sure if we can put that up. Oh, they will be gotten to in the rezoning. So well I I [1:40:37, 1:40:46]: think because the annexation wouldn't be conditioned on the in any kind of conditions that would come through on the rezoning component. So we're not [1:40:47, 1:41:07]: We're not there yet. You're not there yet. No, sir. Because I think in our group, in our discussion, we had uh I think you were on the call, right, Miss Barber? Where we talked with Miss Battle about the uh uh this community. Yes. Yes. About put about uh the buried and there was going to be some um multiple. [1:41:07, 1:41:27]: The family rentals were senior citizens. That's that is correct. So that they could afford that. Yes. And that that is still present within their compatibility. I thought that was contrary to what their their request was. No, so these units will be fee simple units, um, but the declarant will be able to rent units. Um that's very important. [1:41:27, 1:41:47]: Um, from our perspective, we're not looking for the individual homeowners to be able to rent units out, but we want to be able to preserve that ability for the declarant because of the fact that we are gonna have some of these assisted living units there and for people who might be transitioning out of the um traumatic. [1:41:46, 1:42:06]: Brain injury facility, we want to make sure that there's an affordability component to this. Additionally, there may be some seniors who can't actually afford to do the 300,000 roughly price point on some of the units. And so that would allow some units to be rental there as well. But this is not intended to be 100%. [1:42:06, 1:42:26]: Percent rental community, it will be a fee simple community. Absolutely. But again, to preserve that right for seniors in the community to have some additional space where that is affordable. I think that was very important to us that that uh because you know we get that call all the time. And for them to be in the community. [1:42:26, 1:42:46]: Community and to be very specific, this is a aged community, which is fifty-five and over, so it has to be someone who is a senior who would be the renter, correct? Correct. Okay. All right. And then uh in addition to that, uh the conditions, I think Highway 42 is along the highway corridor. Is that correct, Warren? Ryan? [1:42:46, 1:42:57]: Yes. Plan which will require the ten foot multi use pass along the frontage on Highway Forty Two in adherence to the highway corridor or the parkway corridor that for the city. [1:42:58, 1:43:18]: That that's correct. We're we I didn't hear proportion. He's saying the highway corridor overlay. Yes. Okay. Yeah. Right. So the path and the frontage off of this property. There's currently no sidewalk there, so they would have the ten foot path to assist with that. Correct. Because okay. All right. So we want to make sure that that's done along with the beautification. [1:43:18, 1:43:23]: Uh that's required in the parkway corridor. Yes. All right, thank you. [1:43:24, 1:43:29]: Any other questions, counsel? Anybody? For for an applicant. Yes. [1:43:31, 1:43:32]: Yes, sir. [1:43:40, 1:43:42]: So so short term rentals. [1:43:43, 1:43:45]: So is that gonna be barrel or [1:43:46, 1:44:00]: So I uh I think that we've left some flexibility there. What we know is that people who will be coming out of the the traumatic brain facility that may want to stay because they are seniors and they want to stay in place there, um that [1:44:01, 1:44:17]: They may want to be there long term, but I wouldn't really see someone coming out and just they're like thirty days or sixty days. Um the intent here is if they're gonna move into that space that they would need to be there for a little while. So, you know, maybe a year or two um of being um on on site. [1:44:21, 1:44:31]: I wouldn't look at that short term like like I said, not like a short term Airbnb ish kind of moment. It would be somebody that would actually need to be there as they are rehabbing. [1:44:33, 1:44:45]: One follow-up question. Go ahead, please. No, the price point would be real well between two fifty and three, somewhere around there. Yes. But the market is what it is. So is that what we're looking at? Yes. All right. [1:44:46, 1:44:47]: Council, any other questions? [1:44:49, 1:45:09]: All right. You got a question, Ms. Barton? Okay, okay. Thank you. Appreciate that. I'm gonna open up the public hearing. All right. For a public hearing, I need uh anybody on my left, which would be on this side over here, if you have any uh positive comments for this particular uh development. Positive comments for my left. See nothing. [1:45:09, 1:45:10]: Middle. [1:45:11, 1:45:18]: Far right. My far right, nothing. Okay. Any comments against this particular development? Am I far left? [1:45:20, 1:45:20]: In the middle. [1:45:22, 1:45:32]: My far right. Seeing none. So I will close no comments for or against. I'll close that public hearing. And on that note, council, I need a motion to accept this proposal. Yes, ma'am. Yes, sir. [1:45:33, 1:45:46]: Since this is in my new district district number five, I'd like to recommend approval of this particular project. Uh it enhances the quality of life and uh offers uh senior housing. [1:45:46, 1:46:06]: Good deal, is there a second? Miss uh Miss Gan, second then. All all in favor of the motion, please indicate. Okay, unanimous decision. Thank you very much. Congratulations. Okay. Okay, now let's move on. Uh comprehensive plan um amendment case CP two oh two, excuse me, two zero two two two-two. [1:46:06, 1:46:06]: Mm. [1:46:06, 1:46:26]: Consideration of a comprehensive plan amendment request by S3 Capital Investments LLC, the applicant represented by Battle Law PC, the agent, to change the future land use designation of certain parcels as are described below from the light industrial to mixed use to high density resources. [1:46:26, 1:46:31]: residential in order to allow for age restricted residential development. [1:46:32, 1:46:43]: Parcel number 071-0103-4014, located within the city limits, stopward city limits with the frontage on Highway 42 North and s and situated at the end of Technology Parkway. [1:46:44, 1:46:51]: Applicant proposes to change the current land use designation from light industrial to high density residential. [1:46:52, 1:46:58]: Continent's at twenty two point zero one plus or minus acres located in land lot thirty one district seven. [1:46:59, 1:47:09]: Process number 071-01034012. Subject property is in unincorporated Henry County with frontage on Highway 42 North. [1:47:09, 1:47:29]: Across from Summit View Drive, applicant proposed to change the current county land use designation of mixed use to the city land use designation of high density residential after the parcel is annexed into the City of Stockbridge city limits. Uh twenty uh twenty acres located in land lot thirty-one of district seven. Planning staff. [1:47:29, 1:47:49]: Recommend approval of this request on August 25th, 2022. The Planning Commission recommended approval of this request. The item was delayed in connection with associated annexation case, and that is it. So, Mr. Ryan, please, sir. Okay. Well, once again, um, like the mayor said, the planning commission unanimously. [1:47:49, 1:47:57]: Unanimously approved this item on August 25th, 2022. Uh on your screen now is the aerial photo of the site. [1:48:01, 1:48:04]: There's aerial site of both parcels combined. [1:48:15, 1:48:16]: Okay. [1:48:16, 1:48:36]: Track one, uh I'll just briefly uh go over this because I previously went over this. For the sake of time, I won't go through all this stuff again. Um uh track one is located at 2125 Highway 42 and unincorporated Henry County. Uh you got you guys just recently approved to annex this into the city. Uh the applicant proposed the [1:48:36, 1:48:56]: Change the current Henry County land use designation of mixed use to the city of Stockbridge land use designation of higher density residential. Since the parcel has been annexed into the Stockbridge city limits. Also, the applicant has a companion rezoning application. Track two is already located within the city of Stockbridge with furniture on house. [1:48:56, 1:49:00]: Highway forty two and situated at the end of Technology Parkway. [1:49:01, 1:49:11]: Um once again the applicant will be developing an independent age restricted residential community. Um the applic the applicant is S3 Capital Investments. [1:49:15, 1:49:35]: Uh additional finding of facts. If the pro since the proposed annexation has been approved and the applicant wishes to proceed with the proposed development, then the applicant would need to combine both parcels for the for both the requested comprehensive plan amendment and the requested rezoning. [1:49:35, 1:49:51]: Combination plat application would be required and it could be handled administratively. Also, once again, a small stream borders the property to the south. It appears to be a tributary of Wolf Creek. Here's the boundary survey for track one. A boundary survey of both parcels. [1:49:54, 1:50:02]: Uh the Henry County zoning map. And you can see that the um the parcel to be annexed is highlighted on the map. [1:50:04, 1:50:12]: This is the City of Stockbridge zoning map. We have a legend on there. You can read and see that the different types of land uses in the area. [1:50:15, 1:50:17]: This is the Henry County land use designation map. [1:50:20, 1:50:22]: This is the conceptual site plan. [1:50:23, 1:50:25]: I'll blow it up a little bit. [1:50:31, 1:50:40]: So you can see the layout of the property. And once again, these these are the this is the rendering of the uh units and what they will look like. [1:50:42, 1:51:02]: uh the analysis of requests. The proposed development is not consistent with the comprehensive land use designation for the subject property. The requested comprehensive plan amendment for the proposed land use designation change is necessary because the current land use designation do not allow the type of development for which the applicant is proposing or do [1:51:02, 1:51:22]: or they do not allow the proposed residential densities. The applicant therefore proposes to change the future land use designation to the of the two parcels as follows. Track one, from uh which was formerly located in Herring County, from mixed use to high density residential. Track two, which is in this already in the city, from light industrial and low [1:51:22, 1:51:42]: Density verse vertical mix use to high to high density residential. The existing light industrial land use designation does not allow residential use uses and existing low density vertical mixed use land use designation is intended for buildings which contain commercial uses on the ground floor and resident. [1:51:42, 1:51:45]: Residential units. Residential use on the upper floor. [1:51:46, 1:52:01]: The properties requested zoning districts are not permitted with within the city's existing land use designations. To allow for the proposed development, the applicant therefore requested the rezoning of the subject property via RZ22-02, which will be heard after this case. [1:52:04, 1:52:09]: Uh finally, the staff recommends approval of the requested comprehensive plan amendment. [1:52:11, 1:52:16]: All right, Council. Thank you, Mr. Ryan. Thank you, Ryan. Council, any questions for Ryan at all? Yes. Go right, please. [1:52:16, 1:52:28]: Uh and Miss Bowder, you can come on up too. Let me uh in terms of this development, and I think, you know, from my perspective, what we did on Campground Road was [1:52:28, 1:52:48]: you know, protect the residential areas and it so that we could uh prohibit unwanted development. In this case, uh this development is zoned currently light industrial, which would uh right next to these residential areas would allow some unwanted development. Two types of things would go and uh [1:52:48, 1:53:08]: This uh light industrial development of this has not changed. Uh things like warehouses, um like um truck stop man? Yeah, truck stops and heavy commercial uses and um some auto repair and things of that nature. [1:53:08, 1:53:28]: Absolutely. And that's why we made the decision to allow Winding Creek subdivision on Campground Road and Winding Creek townhomes because it protected the residential. Sometimes we take these zonings when they come forward as an opportunity to protect the residents in the area where we can make sure that this is residentially developed going forward. [1:53:28, 1:53:46]: forward uh in keeping with what is in the in the area because nobody that live in the magnolia that Eagles Landing or the summit at Eagles Landing wants a truck stop or a warehouse uh in their residential area. So this is uh these is consistent with what we've done uh in the past. [1:53:47, 1:54:07]: Uh also uh in terms of the connectivity, we when we talked about this, we talked about uh the connection to Technology Parkway and then potentially talking with G Dot about a traffic light uh at uh Technology Parkway to assist the seniors in exiting uh this neighborhood. [1:54:07, 1:54:08]: Yeah. [1:54:08, 1:54:28]: Yes, uh they will have to coordinate with Henry County DOT DOT and uh G Dot on the traffic uh light. Um also we're requesting that they do a traffic study. So all after all those um factors are taken into consideration, a determination will be made on whether or not they can approve a a traffic signal or not or not based on their research. [1:54:29, 1:54:39]: Okay. I is that what the intent is, Ms. Battle, to deceit and assist these residents who have requested a traffic light at this area? [1:54:39, 1:54:59]: Uh Michelle Battle with Battle Law 3562 Habersham at North Lake, Tucker, Georgia, 30084. Um yes, we are prepared to do the traffic study and um discuss with uh GDOT the um installation of the traffic lag. I know that that was something that was already being pursued and we believe that the um additional [1:54:59, 1:55:18]: units should help with the warrant study with regards to that. But as we know, the Department Georgia Department of Transportation requires a traffic warrant study to be done to determine whether or not a traffic light is suitable. So again that will be a part of our process. All right. Thank you. [1:55:19, 1:55:21]: Council, any other questions for um [1:55:22, 1:55:26]: Ryan or Miss Battle. And if not, it's once again this is a public hearing. [1:55:26, 1:55:28]: Uh so I'll open this up. [1:55:28, 1:55:45]: I'll start on my left hand side for uh any comments for uh this change to occur. On my left side, in the middle, and my far right. Anyone oppose on my left side? [1:55:45, 1:56:05]: The middle on far right. I see no oppositions, no uh no approvals. Uh so I will close the public hearing. On that note, council, I need a motion to accept this change. Mayor, I'd like to make a motion uh for approval of as recommended by staff and the additional uh comments made by the applicant. Ms. Barber, do you want to [1:56:05, 1:56:25]: second that second okay it is great so if on that note all in favor please indicate all right unanimous decision fantastic congratulations all right um rezoning case rz 2022 zero two consideration for rezoning request of s3 capital investments lc the applicant [1:56:25, 1:56:34]: Represented by uh Battle Law PC. Uh the agent uh agent to re to rezone certain property from [1:56:34, 1:56:54]: Office institutional O L to L I Light Industrial and the Starbucks City Limits and Mix MU Mixed Use in the Unincorporated Henry County of PUD Plan Unit Development to allow for an age restricted residential development. The property contains two parcels and are listed uh with four. [1:56:54, 1:57:14]: 42.01 acres. Processal number 071-01034014. Located within the Stobber City limits with frontage on Highway 42 North, situated at the end of Technology Parkway. Currently zoned OI Office Institutional and LI Light Industrial. [1:57:14, 1:57:24]: Property also lies within the Parkway Mixed Use Overlay District, contains twenty two point zero one acres, located located in landlot thirty-one of District 7. [1:57:24, 1:57:33]: Process number 071-0103-4012. Subject property in the unincorporated Henry County with frontage on Highway 42 North. [1:57:33, 1:57:37]: Across was Summit View Drive, currently zone MU mixed use. [1:57:38, 1:57:41]: Contains twenty acres located in landlock thirty one of District Seven. [1:57:41, 1:57:45]: Planning staff recommend approval of this request on august twenty fifth, twenty twenty two. [1:57:46, 1:58:06]: Planning Commission recommended approval of this request. The City Council postponed the vote on this item until January 9, 2023 meeting in order to await the decision of the Henry County Board of Commissioners who offered an objection to the annexation. However, at the November 14, 2022, Henry County Board of Commissioners, Henry County rescinded their objection, which allows [1:58:06, 1:58:21]: for the city council to render a final decision on the anxious on the annexation and accompany zoning uh request for this proposal project. This item was delayed in con uh connection with the associated annexation request. Ryan, please. [1:58:21, 1:58:22]: Thank you. Uh [1:58:22, 1:58:25]: on the screen. Uh once again um [1:58:25, 1:58:33]: I'd like to reiterate that the um planning commission voted unanimously to approve this item right here. On the screen now we have um [1:58:34, 1:58:36]: Uh aerial photo of the site. [1:58:37, 1:58:42]: Uh on the screen now is an area photo of both sites and what the site will look like after it's combined. [1:58:44, 1:58:45]: Um [1:58:52, 1:59:00]: The applicant is seeking to um to rezone to PUD. The two parcels combined will have a total acreage of 42 acres. [1:59:09, 1:59:29]: Uh once again, this the pro the project description is independent age restricted residential development to include both parcels. Track one would include the existing Southern Crescent Rehabilitation and Retirement Center and the construction of a hundred new independent living units, including seven detached units and ninety-three attached units with a density of five units per acre. [1:59:29, 1:59:49]: Two, which is currently vacant, will feature the construction of 176 independent living units, including 52 detached units and 124 attached units, with a density of eight units per acre. The total development, including both parcels, will contain 276 independent units independent living units with a density rate of 6.6 units. [1:59:49, 1:59:58]: units per acre. Um we've already heard the two companion application. We heard the index annexation, which was approved, and um comp plan amendment that was approved. [2:00:03, 2:00:05]: Uh, here's a picture of the boundary survey. [2:00:09, 2:00:14]: Boundary survey of both parcels. Uh here's a picture of Henry County's zoning map. [2:00:18, 2:00:20]: City of Stockbridge zoning map. [2:00:24, 2:00:27]: Henry Herring County's land use designation map. [2:00:28, 2:00:33]: And a con here's a conceptual site plan which you've seen two times already, so [2:00:36, 2:00:45]: Here's a picture of the rendering of the proposed units. They'll be made mostly out of hardy paint and contain two-car and single-car garages. [2:00:47, 2:00:56]: Uh the proposed development is not consistent with the comprehensive plan and land use designation for the subject property. The comprehensive plan amendment is needed. [2:00:58, 2:01:04]: Because the the current land use designation do not allow the type of development which the applicant is proposing. [2:01:05, 2:01:07]: Um there we [2:01:10, 2:01:30]: Okay. Rationale for the rezoning. The rezoning of the subject property to requested PUD is necessary because the proposed development would include both attached and detached units as well as the existing Southern Crescent Rehabilitation and Retirement Center. The property is justified for rezoning to PUD as opposed to MFR due to the inclusion. [2:01:29, 2:01:45]: Of the Southern Crescent and the presence of the Wolf Creek tributary and its associated floodplains, which necessitates some flexibility in site design, which the PUD zoning district allowed. Since the proposed development would be primarily composed [2:01:45, 2:02:05]: A residential use is the requested PUD zoning would be compatible with the MFR zoning districts to the west, south, and east, where the Magnolias at Eagles Landing, the Highlands at Eagles Landing, and the Summit at Eagles Landing subdivisions are located. PUD zoning would also serve as a good transition from the LI and OID. [2:02:05, 2:02:25]: Districts to the north. Further, a PUD zoning district will be compatible comparable to Henry County's MU mixed-use zoning district for track one. The subject property has an unusual shape and is traversed by a tributary of Wolf Creek. These may present challenges to the final site. [2:02:25, 2:02:45]: Design of the property. The applicant's conceptual site plan showed that due to the presence of the screen, the proposed residential units would need to be separated into northern and southern sections on the site. A bridge would likely be needed to needed to be constructed over the creek, and the units in the southern section would be constructed away from the floodplains. [2:02:45, 2:03:05]: Impact upon adjacent property owners. The proposed development would be compatible with adjacent residential uses to the west, south, and east. And it would be a good transition from the warehouse uses and church uses to the north. Impact on the water and sewage system. A letter from Heron County Water Authorities dated March 23rd, 2020. [2:03:05, 2:03:17]: 22 state that water service, sewage treatment, and sewer line treatment are available at the subject property, but that the proposed project layout conflicts with an existing eight-inch sewer line. [2:03:18, 2:03:38]: Traffic and transportation impact. The conceptual site plan shows that the proposed development would have three accesses. These include the existing driveway, which serves the Southern Crescent Rehabilitation and Retirement Center, the extension of Technology Parkway, and a new access from Highway 42 across from Glenmore Drive. Since Highway 42 is the [2:03:38, 2:03:55]: state route, the developer should coordinate with both Georgia DOT and Henry County DOT and providing deceleration lanes at all three accesses, as well as the possible installation of a new traffic signal. Pedestrian crosswalks should also be installed. [2:03:57, 2:04:17]: Uh the proposed development qualifies for the requested PUD zoning because it meets the requirement that PUD district contains the two contains at least two types of residential uses. The proposed development would also further the objectives of the parkway mixed use overlay district by including a mixture of land uses representing an attractive gate. [2:04:17, 2:04:37]: Gateway into the city and representing an innovative type of development. Suitability on the present zoning. Track one could be developed under its existing Henry County zoning classification of MU since it is similar to that of the city's PUD. Track two could also be developed with additional warehouses and office institutional uses. [2:04:36, 2:04:46]: However, due to the regular shape attract to the development of those types of uses may be challenging and PUD zoning offers greater flexibility in land use and site design. [2:04:49, 2:05:00]: Um based on those based on meeting those criteria, staff recommends approval with um 19 conditions. [2:05:01, 2:05:02]: Um [2:05:04, 2:05:12]: Okay. Okay. Um Ryan, uh Council, I guess Miss Battle you might want to come kinda mic just in case of or or Miss Carter. [2:05:13, 2:05:13]: Um [2:05:14, 2:05:17]: Uh you have additional comments, Ms. Carter? [2:05:17, 2:05:20]: Uh just a few. [2:05:22, 2:05:31]: What what you see is we we've broken down the conditions, let me make this a little larger. We've broken down the conditions by category and that'll oop [2:05:37, 2:05:38]: We come back. [2:05:41, 2:05:45]: Like twenty twenty seven or twenty. [2:05:45, 2:05:52]: Well you have it in front of you. Um we may have some technical difficulties with the conditions, but we broke them down in categories by um [2:05:52, 2:05:57]: 'Cause the rezonings are where you put conditions on projects. And [2:05:57, 2:06:00]: Of course they had to get the annexation approval. [2:06:00, 2:06:20]: They had to get the comprehensive plan amendment, which you both which you all um approved tonight. And then, of course, they do have to do a recombination approval to combine the two parcels into one to begin the development process. And then what we've done is in front of you, you guys have um you have the uh order and [2:06:20, 2:06:40]: Sewer availability portion, the adherence to conceptual site plan, and building and development, where we've put in 19 conditions within that that were specific to the original rezoning when the county took place, when the county approved this several years ago. We did remove a few, but [2:06:40, 2:06:55]: But it still stands true to the primary wishes that the county had that the city agrees with from the staff perspective. And this is what our recommendation is. So if the applicant has anything. [2:06:55, 2:07:15]: We we just in case uh council you have any questions for Ms. Car Carter at all? Yeah one. Okay. Excuse me. I have one. Go ahead, please. Certainly uh this project uh would be an enhancement for the area. The only question is well, there's some discussions with Henry County. I know Highway forty two is in a long term widening uh for the roadway. I think [2:07:15, 2:07:25]: it maybe twenty twenty seven, twenty twenty eight, something like that, some way out. But uh hopefully this would uh help aid in some of that uh trap traffic release until that comes forward. [2:07:26, 2:07:36]: Correct. Um the requirement and what we talked about earlier was the traffic study. That is one of the zoning conditions here for the applicant to adhere with to that to Henry County and the city. [2:07:37, 2:07:37]: True. [2:07:38, 2:07:40]: Any other questions from Ms. Carter Council? [2:07:40, 2:08:00]: If not a question for Ms. Battle, who's here present as well. So uh Michelle Battle with Battle Law 3562, Haversham at North Lake, Tucker, Georgia. Um there were a couple of the conditions um that we wanted to make sure, I don't know, did you have that markup? Um, that we wanted to make sure um had been adjusted. [2:08:00, 2:08:04]: addressed um as a part of the zoning. [2:08:58, 2:09:18]: So while um while we're kinda looking for that document trying to get that, well one of the things um that was a a change which was a change in the name of the facility. So on your one of your first conditions under number six, you have a it talks about a memory care facility, um, but it [2:09:17, 2:09:37]: after speaking with the applicant, it in fact is considered a trauma brain facility instead of memory care. And then there was one other change that was actually very specific to the Henry County rezoning that did no longer applied to some degree. [2:09:37, 2:09:41]: And it was letter I [2:09:42, 2:09:52]: as it talks about there being a limit to the maximum of uh uh sixty units, that should in fact be one hundred dwelling units. [2:09:55, 2:09:57]: Okay, here we are. Alrighty. [2:10:11, 2:10:11]: Okay. [2:10:16, 2:10:36]: So you see here is depicted as it speaks of an approved development permit shall be limited to a maximum of 60 dwelling units. That was when the project was only 100 units total in the in Henry County. But having a hundred units where you have to [2:10:36, 2:10:56]: have an approved development permit is is amenable on the staff level. And we would just remove references to Henry County. And then we would add where it talks about the 61st unit, we would require that to be the 101st. [2:10:56, 2:10:56]: [7858.9, 7860.1]: If that's as clear as mud. [2:11:01, 2:11:03]: So w when these appropriate changes will take place? [2:11:05, 2:11:17]: So as as part of the zoning conditions. Okay. It would be those would be the um the recommendations from staff. Okay. Um that we're amenable to the applicant as they're just some minor typos. Right. [2:11:19, 2:11:39]: And just to reiterate, um the issue with regards to item nine is that um it was originally anticipated that um there was going to be a second entrance point that would have been off-site. And so um what we are doing is clarifying that there are going to actually be three points of entry um and the way that [2:11:39, 2:11:59]: That they had it was that you couldn't get past the sixty f 60th unit until that second entrance was installed. And what we are saying is we're gonna have three points of entry. Um, and we would like to have up to a hundred units because we now have over two hundred units. So um [2:11:59, 2:12:12]: The hundred units seems to be reasonable. The sixty not so much when we are now increasing by two fold the total number of units that are being installed. So basically what we all we're saying is that [2:12:13, 2:12:33]: Until we have two or more entrance points, we can't build over a hundred units. Um and we know that as a part of the um transportation study that is a part of the conditions, that we will have to agree to make all of the right-of-way improvements and the installation. [2:12:33, 2:12:53]: Of the three points of entry over the course of the development of the of the project. So that is why we are asking for that change. So again, instead of it being you can't build any more units until you install, or can't build more than 60 units until you install two entrance points, we would like to [2:12:53, 2:13:05]: to say we can't build any more units until we uh up to a hundred. We can build up to a hundred units, but we can't build that hundred and first unit until we have two or more points of entry. [2:13:05, 2:13:25]: I appreciate the I appreciate the clarification. That's that's helpful for me. I was hoping it's helpful for the council as well. Right. Thank you. And and and then the only other thing was as stated was the fact that we are a traumatic brain injury um facility and not a memory care facility. Um there was also one other point with regards to the [2:13:25, 2:13:26]: Um [2:13:27, 2:13:47]: number of pavilions that was being provided. Um in number five it talks about the community center, which we are building with the fitness and the meeting rooms and the business center. We will have the two cabanas, the two swimming pools, which contains the outdoor areas with the walking trails. I believe we were only doing two. [2:13:47, 2:14:07]: Pavilions and those pavilions again will be the clubhouses. There will be two separate clubhouses. So we just wanted to point, make that one last point that we would like that to say two pavilions as opposed to three. But again, we've got two complete clubhouse. [2:14:07, 2:14:12]: with Pool and and all the other amenities in two different locations on the site. [2:14:13, 2:14:13]: Okay. [2:14:14, 2:14:20]: Council, questions. Yes. Ms. Carter, is that consistent with what the staff recommendation? [2:14:21, 2:14:27]: Um we are just hearing about the the reduction in the number of pavilions, but outside of that, um yes. [2:14:28, 2:14:40]: What's your p what's your opinion on that? I I think it'd be fine. Um the amenities in accordance with the current code are are beyond they're re putting in beyond what's required of the code today. [2:14:40, 2:14:41]: All right, thank you. [2:14:42, 2:14:45]: Questions, council, any other questions, concerns? [2:14:46, 2:14:48]: Yeah, I'm not sure. Go ahead, sir. [2:14:57, 2:15:00]: Three dollar two. You got an image. [2:15:01, 2:15:21]: Um in this it requires the pavilions to be no less than twelve hundred square feet, and I know that the um clubhouses won't be uh less than that. They'll be more than that because uh I think one of the clubhouses will actually have an indoor pool. So one's gonna have an indoor, I think, and one's gonna have an outdoor. So these are gonna be substantial um community spaces because [2:15:21, 2:15:34]: because again it has to have um the the meaning, the fitness room, the business center, all that kind of stuff. And so we're actually duplicating in most communities you would only find one, but we're actually gonna have two sets of these. [2:15:35, 2:15:45]: Another question I'm fighting for missed this. Because of the the type of facility this is, what is the security uh aspect of it? [2:15:45, 2:15:55]: Um with regards to security, we've haven't had a h lot of discussion um surrounding that. Um it is not uh intended to be a gated community at this point. [2:15:55, 2:16:09]: So, um my understanding is that security will probably be kind of standard um security. Um probably have some cameras and things like that around throughout the community, but um there was no like [2:16:09, 2:16:14]: security guards or anything like that that have been planned. [2:16:17, 2:16:18]: Mm-hmm. [2:16:19, 2:16:39]: Mm-hmm. There are there are a lot of senior yeah, there are a lot of senior um communities that are around. Um, I guess for good or for bad, I I've visited a number of them. Not only well, for my sister, I haven't um decided that that's for me yet. Um, but I have been to a number of them and the mass majority of them don't have any [2:16:39, 2:16:40]: Not particular security. [2:16:42, 2:16:42]: Mm-hmm. [2:16:49, 2:17:03]: For some, uh I wanted to be clear, the mass majority of the people that will be living in this community, we believe, will just be independent seniors who are looking for um a community that is age restricted. [2:17:03, 2:17:23]: That we believe will be the mass majority of the people that will be living there. There will be the opportunity for people who are in that traumatic brain facility, however, to also live within that facility and have the care that they need by being so close to the traumatic brain um facility. So it will have kind of a dual [2:17:23, 2:17:36]: dual aspect, both what I would call independent and some assisted um living as well. Um but we believe that, you know, any senior that's fifty-five and older that would like to live in this community will have the opportunity to do so. [2:17:38, 2:17:58]: Any other questions? Yeah, let me one more. I'm sorry. That brought thank you to Mr. Blount. That question brought up something very interesting. Because uh I think Minding Creek uh town homes, they have a gate uh for their community, which is multifamily, which offers but the streets were still gonna be public streets because uh [2:17:58, 2:18:18]: We were gonna give them that designation, I think. Um so uh is that even an option for this to have some type of protection, especially maybe at nighttime to have a gate? So we've got three points of entry. Um the one point of entry is actually coming through where the traumatic brain facility is at. [2:18:18, 2:18:38]: They'll have kind of a shared easement, a shared drive into that space. And then you also have the um the the entrance that's dedicated where the um single family detach units are are located. And then you'll also have the one off the back where it goes through the [2:18:38, 2:18:58]: Um the Atlanta Tech Center area. And so there had not been any plans to have a gated community there with those three points of entrance. That does require some juggling of the site to a certain extent because you have to have the depth of the driveway and the turnaround. [2:18:58, 2:19:06]: um and and those types of things that would go with it. I don't know that we're necessarily opposed to it, um, but it was not contemplated. [2:19:06, 2:19:17]: Well Miss Carter step back up real quick. In terms of that, we had there was some discussion anything involving multifamily would have a gate. So what where what what what does the code say? [2:19:17, 2:19:24]: Uh the code does not require multifamily to have a gated entrance. It doesn't require any subdivision to have it. Um [2:19:25, 2:19:45]: It it does depend on, you know, we go through the final plat process, which we will go through for this and other projects like it. Um, it's determined by the applicant if whether they like for it to be private, which means it will be gated, uh, versus it being not not gated and it being um on the maintenance for our public works. [2:19:45, 2:19:51]: Is it a tr is it a combination where it could be gated and then the streets still be public? Is that allowed or no? [2:19:51, 2:19:53]: Um we haven't [2:19:54, 2:19:59]: broach uh breach that that aspect, um, but typically when it is gated [2:20:00, 2:20:12]: the HOA takes on the cost of maintenance for that for those streets. Because this is a really busy highway and it might be a good idea. [2:20:24, 2:20:25]: Yes. [2:20:25, 2:20:27]: I didn't hear the question, sorry. [2:20:29, 2:20:49]: Okay, certainly we were entertained that about uh potentially having gates because this is a very busy highway, which is gonna be a four lane uh major artery when it's widened uh in the coming years. So certainly uh I I think that the the uh [2:20:49, 2:21:09]: I if it is something that we can have discussion about um as we're going through the park, I don't think we're opposed to it. I think the challenge is which one of the entrances would have the primary gate. Um because one of the things we don't want to have is um cars out into um the right-of-way. You have to have a depth on the [2:21:09, 2:21:29]: The entrance in order to have a gate. And so right now it's not set up for the gate, which means that we would have to adjust some of the entrance points because I believe you have to have a stacking capacity and then you have to have a width wide enough in order to allow not only for you to come through the gate, but if you can't get in, that you have to be able [2:21:29, 2:21:36]: to make that turnaround to come back out. So we would have to make some adjustments with the site plan in order to be able to accommodate a gate. [2:21:37, 2:21:57]: I I I think honestly that's the way to go. And I think technology parkway would be the roadway that you would have to use uh for the m primary entrance. Hopefully there'll be a traffic light at that one day. But the concern would be and I've seen this uh in some subdivisions in the area off of Brandon Road and [2:21:56, 2:22:16]: Campground Road where people were using Highway 155 coming into the subdivisions during the night and um victimizing those areas. So having the gate there might have assist in that. So I certainly would like I can't only speak for myself, but I certainly would like to see that. [2:22:18, 2:22:20]: You know the question from the council. [2:22:21, 2:22:32]: All right. If not, I'm gonna open up the for the public hearing. And so um any comments on my far left for this project? Any comments on my far left for? [2:22:33, 2:22:40]: Seeing none in the middle, my far right. Any comments against the project as stated? My far left. [2:22:41, 2:22:42]: In the middle. [2:22:42, 2:22:43]: A far right. [2:22:44, 2:22:48]: Well actually on that case, no comments for or against, so a public hearing is closed. [2:22:48, 2:22:50]: Council, I need a motion to accept this proposal, please. [2:22:51, 2:23:07]: Mayor, I'd like to make a motion to approve this, but I would like to add the condition that we just discussed, which is requiring the gate um for this uh development uh being that it's multifamily with uh so many people being in that area. [2:23:10, 2:23:24]: All right. Mr I'm sorry, Councilman Alexander, um, are you accepting the conditions with the amendments as stated earlier in addition to your co yes your condition? Yes, and and staff recommendations and amendments. [2:23:28, 2:23:30]: Is there a second to this motion? [2:23:31, 2:23:40]: Mayor. Yes, ma'am. I have a question. Yes. Um there were three entry points. Um Councilman Alexander, is that gated on all three? [2:23:40, 2:24:00]: mean if the gate is required for all three, you're gonna gate the community. And then um of course the main entrance would be she the question was the main entrance would be off of technology parkway because in the future there's a long run there where there's other businesses located and hopefully there will be a future traffic light there. [2:24:00, 2:24:15]: And I ask and I call on the council to support this because this is about safety. That is going to be another I seventy five running right through that area with four lanes and then paths and sidewalks on both sides. Stand by. [2:24:17, 2:24:20]: Oh Dr. Sowell said he could talk to them. [2:24:20, 2:24:40]: If I may, if I may, um because there is a traffic study that still is to be done, it would be determined by the Henry County DOT, the state DOT for Highway 42, and the fire marshal on emergency access and what the main entrances would be. So that information is still yet to be determined. [2:24:40, 2:24:55]: Um, but as far as the gating piece, um if the property is gated, it does require that they be private streets and that those have to be maintained by the developer and likely the homeowners association. [2:24:56, 2:24:57]: Yeah, it kind of like increases. [2:24:58, 2:24:58]: No. [2:25:00, 2:25:01]: Meh. [2:25:02, 2:25:06]: Go ahead please. Thank you. You're welcome. Go ahead, please. [2:25:06, 2:25:13]: Uh one of the things uh I wanna say that we have to be careful when we start talking about and I I agree with uh having security to the [2:25:14, 2:25:24]: to the mo utmost that we can put in there, but we have to l also look at communities like my community. The highest traffic volumes in my community is those people are cutting through the community. [2:25:24, 2:25:44]: So if we gate if we gate my community, then if we set a standard that we're going to allow communities to gate themselves and and we approve and still do the streets, then that opens it that sets the precedence for other communities such [2:25:44, 2:25:50]: Because we're not gonna let a development come in and we gate that community. [2:25:50, 2:25:53]: And we still maintain the streets when we do have a [2:25:54, 2:25:57]: We have a safety situation in my community. [2:25:58, 2:26:02]: And if we gate it, then we would have to take over those the the cost of those streets. [2:26:02, 2:26:22]: And I agree that when you gate a community, the the the cost is substantially raised. And you cannot just get it off of um the what is the standard now for buying at home. The HO the the the the HOA is definitely [2:26:22, 2:26:33]: gonna be uh put that home in a price range much higher than what that mortgage would normally be. And so we have to be careful and cautious if we set that precedence [2:26:34, 2:26:45]: now tonight that that president's gonna have to be abided by other communities that are existing that has safety issues like we have in Winsome. [2:26:46, 2:27:06]: A good example of that would be the Eagles Land Country Club, which is a gated community, which means obviously they have to ba maintain those roads. Those are not roads in which the City of Stockbridges maintains. And that's what would happen with that in this aspect when you do that. I think the the other component to remember for our seniors in this particular community is that um there are [2:27:05, 2:27:25]: Going to be paying a substantial amount because they have to maintain all of the common areas along with so the pool and all that other stuff, they're maintaining that along with the exteriors of the townhome units and the of the buildings. And so when you then put on top of that that maintenance component with regards to [2:27:25, 2:27:45]: the streets if there's potholes if there's other issues and the gate and the mechanisms for the gate maintaining all the gate is just a lot of cost that we had really not contemplated. Um so we would prefer not to put that as a condition at this point but to give us an opportunity to work with staff and with the commissioner i mean with the council members to figure out um [2:27:45, 2:28:05]: the best way to address the safety issues and concerns because we don't want to outprice um people being able to live there with the um the assessment. You know, it's one thing to pay your mortgage, but it's a whole nother thing if you gotta pay, you know, an extra hundred dollars uh a month or fifty dollars a month in order to have all these additional um amenities that are [2:28:05, 2:28:25]: are going to have to be covered because a lot of these folks are going to be on fixed incomes. So as maintenance increases, then their assessment is going to increase. But that doesn't mean their income is increasing because they are seniors and a lot of them are going to be on fixed income. So I would just ask that to be taken as a part of the consideration. But um Councilmember Alexander, we certainly understand [2:28:25, 2:28:31]: What your concern is, and we're more than willing to have continued dialogue and to see if we can work towards something that might be amical. [2:28:32, 2:28:33]: Mr. Anzan, go away, please. [2:28:34, 2:28:47]: Yeah, I just saw again, right around the corner, at the Winding Creek townhomes, they have a gate. Uh they only have one entrance hour and they only have forty seven units. So the staff recommendation was to do what again, Ms. Carter? [2:28:49, 2:29:09]: The SAF recommendation as far as uh there wasn't one as far as the streets, um, but it's for the conditions. You said to get back to them once through the process once the traffic study and everything is done. Yes. To continue to have this as a discussion point until we get that. [2:29:09, 2:29:10]: That information in. [2:29:11, 2:29:17]: Um we we can. Um we just have to determine the mechanism to bring it back. Um [2:29:19, 2:29:39]: to you all formally because um until the traffic study's done and that usually can take a couple of months, um maybe six to eight weeks, then bringing it back to you all would require us to come back formally. Well um in terms of that, I mean, isn't that some determination you could make administrative [2:29:39, 2:29:42]: Absolutely. [2:29:42, 2:29:43]: Yes. [2:29:44, 2:29:59]: Okay, so um well I remove my contention they're gonna continue to work on that particular issue in terms of determination of whether the gate's gonna be and accept the staff's recommendations uh uh with the conditions included. [2:29:59, 2:30:10]: And that's your motion now. You readjust your motion? Yes. Okay, is there a second to that motion? Miss Barber seconds to that motion. Any further discussion? And if not, on fair please indicate. [2:30:11, 2:30:13]: I wonder because a lot of [2:30:16, 2:30:33]: I have the motion recorded by Councilman Alexander to approve with the nineteen conditions as proposed by staff and any amendments that were made tonight, but as far as the gate is concerned. [2:30:35, 2:30:41]: There is a traffic study that's going to be completed by uh with DOT to determine [2:30:41, 2:30:48]: Whether or not a gate would be needed because that would cause the development to have private streets. [2:30:49, 2:30:50]: Mm-mm. [2:30:50, 2:30:59]: Okay, let's double check. So with with with that being said, so are we at a point in this motion where whenever this study is completed [2:31:00, 2:31:18]: Are we talking about a change in the price point of the the b uh uh or of w I'm just trying to figure out if we approve it, then what do whether they do the study and complete the study, what does that have to do with the approving of the project tonight? I I don't I don't understand that. If we're not requiring them to put a gate up, why are we [2:31:18, 2:31:18]: Well. [2:31:19, 2:31:39]: But I think I think what the the request was that after the traffic study is completed, that it's determined from there and the clients work together to determine whether they can, you know, look at the price points and how that'll affect the costs to the homeowners to determine whether they can put in those those private streets. [2:31:39, 2:31:42]: Y y and that's fine. I I get it. [2:31:43, 2:31:49]: But if the traffic study is done and they're determined not to do it, then what? They're just determined not to do it. So what's the point? [2:31:51, 2:31:59]: Well, I guess. If you approve it tonight and they decide not to do it, then what's the point of the stipulation? What's the point of that contingency? [2:32:01, 2:32:21]: All right. Understood. Um, but that's that's a dis decision if you all wish to add it or not. Um it it it has no it has it has no weight to it. Mayor. It it does have weight in terms of the fact that the the the information and the the information is gonna make the decision versus um us. [2:32:21, 2:32:25]: Okay. All right. Ms. Gandhi have a question? [2:32:25, 2:32:43]: I have to agree with Councilman Blount that it really doesn't hold any weight. Um, I mean you're an expert in this field. Does that hold any weight? The fact that the traffic study I thought the traffic study was for a traffic signal, whether or not there will be a need for a traffic signal, not [2:32:44, 2:32:46]: Miss um holiday. [2:32:46, 2:33:03]: Not the gate, but the traffic signal. Was that not the purpose of that study in the first place? This came in this came up later. That's that's what it was, Miss Battle. Thank you. Um, so this is not about a gate. This is about a traffic signal. [2:33:05, 2:33:25]: And that's what G Dodd and everyone determined and and that would make sense. So whatever we vote on tonight, if we don't vote on it tonight, we don't vote on the gate tonight, or put that in as part of the condition, then it doesn't even matter. We're just going based off our word. And then that's exactly what [2:33:25, 2:33:33]: Councilman Blount was trying to say. Now, I'm not really um necessarily saying let's get a gate. [2:33:34, 2:33:54]: I I'm not saying that. I'm not saying that, especially when we are talking about the roads becoming private at that point, that it automatically would be private. And we just heard that the cost would increase significantly. We know that the cost would increase significantly. Those of us who have lived in Eagles Land and will I [2:33:54, 2:34:05]: I have would know that. So I'm not going to say that that would be necessarily the case. I'd if I'm gonna vote on, I'm gonna vote on the conditions. [2:34:06, 2:34:07]: That were given. [2:34:08, 2:34:08]: Tonight. [2:34:10, 2:34:18]: Along with what we've just discussed. If we're gonna vote for the gate tonight, let's vote for it. If we're not, then that traffic study's not gonna do us any favors. [2:34:18, 2:34:38]: For that. I I can say this on behalf of the applicant, Dr. Sowie, um, if if you all would like for him to speak. But here's what his concern is. He's asking not to have the gate. I'm just gonna sp flat out say it. He would prefer not to have the gate because he's also concerned about the fact that we have both independent and some assisted living. He doesn't want to [2:34:38, 2:34:58]: slow down in terms of um safety um not safety um uh response um if there's any type of emergency within and they have to deal with getting through the gate that's time away from being able to get to the person behind the gate and so there's some concern there because it is a senior community um we don't [2:34:58, 2:35:18]: Want to slow down any type of emergency response time getting into the community, in addition to the fact that we know that it is going to increase the cost for the residents because they will have to maintain those private streets, and that's going to add significant additional money. [2:35:18, 2:35:33]: monies onto their um assessments. So we would prefer not. That's obviously you all's decision to make, but that is our position on it. So and that's based on what Dr. Sowie has just asked me. So I'm just making sure that that's clear from our perspective. [2:35:34, 2:35:40]: I prefer not to have the gates. All right, knowing all that, Ms. Alzheimer, you're the one who made the motion. I made the motion. [2:35:40, 2:36:00]: I didn't make the motion to approve the gate tonight. I made the motion to have the staff and working with the vendor to determine whether or not the gate would be necessary after all of the data is gathered, including the traffic study and including um uh re examining uh the depths of the [2:36:00, 2:36:10]: the interest is required and all of that. Uh all of that information will be taken into consideration. That's the motion that I was making, not uh that the gate would be approved tonight. [2:36:12, 2:36:25]: All right. Now and who second uh Bess Barber, you second that? Who second that most discussion page may hold on sir. Okay, so originally it was it was originally it was seconded. Who s originally seconded that? [2:36:26, 2:36:43]: Ms. Barber, okay. So it was originally second. All right. Now we had not had further discussion. You want to have further discussion? It's fine. But a motion has been made and we're seconded. Mr. Alexander just re reiterated that particular motion that he made. And I'm pretty sure that the uh uh that the clerk has that n that interpretation. So it's further discussion, go ahead, please. [2:36:44, 2:36:47]: Mayor. [2:36:47, 2:36:49]: If the traffic study comes back. [2:36:51, 2:36:55]: And it says traffic is off the chain. [2:36:56, 2:36:58]: And they still decide not to put a gate up. [2:36:59, 2:37:02]: The city, can we make them put a gate up? [2:37:08, 2:37:09]: I wouldn't say that we could. [2:37:10, 2:37:13]: There's no community that we can make put a gate up. [2:37:14, 2:37:14]: Right. [2:37:15, 2:37:16]: So what's the point? [2:37:17, 2:37:20]: That's what I'm trying to say. Why put that in in the motion? [2:37:21, 2:37:24]: The point is it may have to respond. [2:37:24, 2:37:29]: Yeah, I'll I'll stand by before you respond. Uh you're done with your comment. Miss Gann, you had a comment? [2:37:30, 2:37:50]: Well uh yes I did. Uh if we don't approve this then it dies. Period. The the subdivision dies. That's one way of handling it. But no one wants to do that. We do want this I wouldn't want to do that. However, um based [2:37:49, 2:37:55]: Based off of the motion that Councilman Alexander made, it's pretty much tabling [2:37:57, 2:38:01]: This agenda item until a traffic study's being done. That's what it sounds like. [2:38:02, 2:38:04]: Because we're either gonna vote on it tonight. [2:38:05, 2:38:09]: Or we'll wait on a traffic study to determine all those conditions to put in. [2:38:10, 2:38:30]: That's what that's where we are. That's pretty much what he did or is saying. No, it's not what I'm saying. If we if we vote on this, then we're waiting if we wait on the traffic study and the traffic study says, Okay, it's a lot of traffic. It's all about a traffic signal. We're waiting on the traffic study to determine what? A traffic signal. [2:38:30, 2:38:32]: Not about a gate. [2:38:32, 2:38:34]: Because whatever we vote on tonight. [2:38:35, 2:38:36]: That's it. [2:38:37, 2:38:38]: Understand that. [2:38:39, 2:38:56]: Well th I th Mr. Alexander, I don't think that's his intent, but go ahead, Ms. Alexander. That's not my intent, certainly not my intent. But in in the end, I know one thing, this city's trying to set a standard. If we want gates and multifamily developments, we need to start now. But in the end, this developer, they gonna be all today. [2:38:56, 2:39:00]: But you know what? They have a decision to make and then they come they're gonna come back. [2:39:01, 2:39:02]: For something else. [2:39:02, 2:39:08]: And we understand what they do and what what how they proceed from this point forward or determine when they come back. [2:39:10, 2:39:16]: So the decision will be up to them on what to do, but we understand that there will be other developments. [2:39:16, 2:39:18]: Mayor Ford. Yes sir. [2:39:18, 2:39:25]: The the issue that I'm concerned about, as was stated, is the escalating cost. [2:39:26, 2:39:29]: For these seniors en and for that reason. [2:39:30, 2:39:32]: I'm hesitant to add [2:39:32, 2:39:35]: Anything that's going to escalate [2:39:35, 2:39:36]: The cost. [2:39:37, 2:39:42]: Uh and and if if that is true, as was stated and if that is a fact. [2:39:43, 2:39:52]: I I like to hear that reiteration, but if that's the case and that's a fact, I I would not be in favor of escalating uh the cost for those seniors. [2:39:53, 2:40:12]: S seeing as that is the case, we don't have support for it. Let us just move forward with it, the recommendations by the staff. We don't have the votes. Let's not waste any more time. We don't have the votes. Let's just go ahead with what staff recommended and I change my motion to go ahead with the amendments and the recommendation uh by the staff. [2:40:13, 2:40:33]: Councilman Alexander, if I may, Mayor Ford. Um, because the security is is one of is the primary concern, the applicant has staged us now that they're willing to put in security cameras um and some s as a condition um of the rezoning in order to to create some security measures um in place on the site. [2:40:33, 2:40:35]: Certainly they'll be acceptable. [2:40:36, 2:40:42]: Okay, so uh you wanna restate your motion once you're gonna be able to do that. [2:40:42, 2:40:48]: the uh staff as well as the security of cameras agreed to by the developer. We [2:40:49, 2:40:58]: Okay. Is there uh uh Miss Holly, you have that, is that correct? All right, no problem. Is there a second to that motion? I second. Um Miss Gantt seconds the motion this time. All in favor, please indicate. [2:40:59, 2:41:02]: Fantastic. Let's move on. Thanks. Congratulations. Okay. [2:41:03, 2:41:13]: Um items number 14, 15, 16, and 17. We amended the agenda to have that uh come to before us on the on the thirteenth of February. [2:41:13, 2:41:20]: And oddly enough that's probably a great thing, uh, because uh we will be here several more hours, right, if we had that. [2:41:20, 2:41:22]: So we're going to new business. [2:41:22, 2:41:41]: New businesses council consideration to approved Yellowstone landscape to perform the Campground Road and Hudson Bridge Road Medium Enhancement Project an amount of seventy thousand one hundred and fifty-eight dollars and ninety-six cents. Funding source from fund balance van uh excuse me, funding source from fund balance presented by Mr. Aaron, please. [2:41:51, 2:42:00]: Yes, Mr. Mayor. Uh this was an item that Councilman Alexander asked us in reference to this project a beautification project for [2:42:00, 2:42:04]: Uh Hudson Bridge Road and Campground Road. [2:42:04, 2:42:17]: And uh Yellowstone, our current landscape inventor, provided a a quote to perform the beautification projects on Hudson Bridge Road and Campground Road. So we just presenting this for information to Mayor and Council. [2:42:18, 2:42:38]: Uh sir. Good, got a good question for him? Go ahead. Yeah, this let's let's be very clear. The council voted and approved the Hudson Bridge Road development, uh beautification, and the campground road. There was a council vote. Now I asked why the these two projects had not been completed. [2:42:38, 2:42:58]: Completed. There was a RFP that was put out based on what the the vote by the council. There were no bids that were actually approved. Is that correct? There were no bids that were submitted. Yes, sir. At that point, uh, I think the former city manager and yourself, we were [2:42:58, 2:43:11]: gonna reach out to Yellowstone and get them to actually complete the project. And what actually happened was uh the previous city manager did not move forward with the project that was voted on and approved by the council. Is that correct? [2:43:12, 2:43:13]: Well uh [2:43:14, 2:43:33]: I don't know what what happened with that. I I just presented the information to him. I knew it exceeded his signing authority. But in essence, what really I mean, there was Yellowstone was supposed to do it, these two projects, but it never happened. Is that correct? Yes. That's what the council voted on and approved. Is that correct? [2:43:34, 2:43:40]: I'd have to look back at the minutes. I don't know if it was officially approved these two projects. Yes. [2:43:41, 2:43:42]: Mayor. [2:43:42, 2:43:43]: Yes, ma'am. [2:43:43, 2:43:57]: It says here that the funding sources from fund balance. Um, does that mean that it's not budgeted for? These two projects are not budgeted for No it wasn't budgeted. How could they not be budgeted? So if they weren't budgeted for, then [2:43:58, 2:44:13]: What did we ness uh madam Clerk, do you recall what we approved? Because if it's not budgeted, I'm not gonna approve something and I I don't have a budget for I can't where's the money coming from? This is coming from fund balance. And I wouldn't have approved that. [2:44:15, 2:44:35]: Councilwoman Gantt, I do not recall that, but as Mr. Aaron has indicated, it was put out for bid, which if the did we I don't know if if the amount was known at that time, which is why it was not processed via the city manager and was put out for via we would have to actually [2:44:35, 2:44:38]: Pull those records. I'm sorry, I'm not recalling that at this time. [2:44:38, 2:44:53]: Okay, thank you. So that means that we don't have it in the budget. It would have to come from fund balance, correct? We didn't budget for this project. No ma'am, we didn't. All right, do we have any supply stores or anything that we could use to fund this project? Moldel, Motel. [2:44:53, 2:45:01]: No, no. Yeah. We cannot. Calm down. So what so what uh so are you finished with your comments, ma'am? [2:45:01, 2:45:10]: I would have to speak with Mr. Wiggins on that as far as the funding source is concerned. Well he said fund balance, so is that the [2:45:11, 2:45:20]: As of right now, we s I said fund balance because it was not specifically identified in the FY twenty twenty three budget. This project wasn't. [2:45:21, 2:45:41]: Okay, thank you. Sir. Uh once one stand by a second please. Mr. Wiggins, you you have uh an answer to that in reference where this money can be the only answer I have is um the funding source like it like we said it's it will have to be fund best because we did not budget this at all. It would take some time to go through [2:45:41, 2:45:45]: and look through back through the budget and see where we can get this money from. [2:45:46, 2:45:50]: Right now going forward, you know, we just started the new year with the new budget. [2:45:51, 2:45:52]: This just wasn't budget. [2:45:52, 2:46:12]: Yeah. All right. Now I think this is like like Desha said, um the seventy thousand comes from Yellowstone because you we did not receive any beds in for when this project went out. So the you didn't we didn't have no price, we didn't know any kind of estimate of what it was. So [2:46:12, 2:46:19]: When this came back, this came back after the budget was done. So [2:46:19, 2:46:21]: Oh okay. [2:46:22, 2:46:32]: I think Ms. Alexanderway, please. Let gentlemen, come on now. The project was approved two years ago. Of course it wasn't in the 2023 budget. It was in the previous budgets. [2:46:33, 2:46:36]: It was in beautification along the interstate. [2:46:36, 2:46:42]: I think we have fifty thousand dollars that we the council approved for that maybe two to three years ago. [2:46:42, 2:47:02]: It was there. And certainly, Mr. Wiggins, you know as well as I know that uh hotel motel tax can be used for tourism and improvements along there. It does not have to come out of fund balance. Is that correct? No, I I would have to check that. [2:47:02, 2:47:22]: That's one of the categories. I I need you to go and do the research. I I can I can do the research. Please do the research. But you have to be careful about using tourism money for one of those funds is unrestricted. I need you to know that. And I need you to go do the research and come back to us. All right, so you'll get a chance to do that, so otherwise it seems as though there were [2:47:22, 2:47:24]: We'll probably have to table this item and for another time frame. [2:47:25, 2:47:26]: Yes. Yes. [2:47:27, 2:47:35]: Mayor, I move that we table this item. I made a motion to table this item until we get more information on funding. [2:47:35, 2:47:36]: Is there a second to that? [2:47:36, 2:47:38]: Miss Barber Seconds that all in favor, please indicate. [2:47:40, 2:47:44]: I oppose. Um I'm I'm okay. We'll cut bring it back to you. Which one are you with, sir? [2:47:44, 2:48:04]: I'm I'm for it. I'm just astounded that we don't even know the rules. Okay, you're f you're for the yes of of the m uh tabling it, is that right? Yes. Okay, so it's four four four zero. All right, it passes. Thank you. Four we're gonna table this item. And obviously when you r I would imagine we'll bring it back in the next uh opportune time for a uh meeting. That's [2:48:04, 2:48:24]: All right, all right, thank you very much. Council consideration approval of annual contract RFP two zero two zero-002 six with site engineering incorporated for on-call water and sewer emergency and operational repair, maintenance construction services, an amount of three hundred thousand dollars as approved in the FY 2023 stormwater budget. [2:48:24, 2:48:44]: The funding source is from the stormwater budget account number 510-4250-542515 stormwater repair. Mr. Aaron, please. Yes, Mr. Mayor, I'd like to uh put a record that the contract was not included in the uh package that Mayor and Council received. [2:48:44, 2:49:04]: But this project was this uh contract was bidded out in twenty twenty one. So we're coming up on the f I think it's the second renewal of this. And this is gonna be a key for us as we transition into the newly annexed areas because we've already identified some areas that we're gonna need some work in and also we got some projects that [2:49:04, 2:49:24]: That we just was made aware today in this on Summit View Drive that we're gonna be working to repair a stormwater project. So this agreement has been very beneficial to the city as we go about making improvements in our in our stormwater infrastructure. So we just ask the mayor and council to approve what was approved in the F. [2:49:24, 2:49:26]: Y twenty twenty three budget. [2:49:27, 2:49:47]: All right, thank you. Is there yes ma'am? Go ahead, please. Mayor, I'd like to make a motion to approve this. It was already budgeted for. Um for council to approve the annual contract RP 2020-0026 with Site Engineering Inc. for on call water and sewage emergency operational repair maintenance. [2:49:47, 2:49:57]: and construction services in the amount of three hundred thousand dollars as approved in our FY twenty twenty three stormwater budget. Is there a second to the motion? [2:50:00, 2:50:01]: Is there a second to the motion? [2:50:05, 2:50:05]: No one [2:50:06, 2:50:08]: Second. [2:50:08, 2:50:13]: Okay, Mr. Alzheimer's second the motion. Any further discussion? If not, all in favor of the motion, please indicate. [2:50:14, 2:50:16]: Okay, I'll pose. [2:50:16, 2:50:20]: Abstain? I abstain. Okay. Three zero one. [2:50:20, 2:50:21]: Motion passed. [2:50:22, 2:50:25]: Council council consideration to um [2:50:25, 2:50:41]: Approved the award or request for proposal number two zero two two-one seven Wastewater Treatment Plant Pole Barn to Diversified Construction of Georgia Incorporated in amount of one million two hundred and seventy-one thousand six hundred and fifty dollars. [2:50:42, 2:51:02]: Funding sources from the Water and Sewer Department Fund Balance Account 505-4330-5541-462. Uh WWTP facility improvements. Mr. Aaron, please. Yes, Mr. Mayor. I'd like to once again state for the record that the contract was not included in your package, but I'll let Mr. [2:51:02, 2:51:05]: Bryant Holsinger, our sewer sewer superintendent speak to this project. [2:51:06, 2:51:06]: All right. [2:51:07, 2:51:27]: Thank you, Mayor and Council, for hearing me. Uh this is a pole barn that's gonna be constructed on at the wastewater treatment plant. Uh it's a hundred and fifty foot long, fifty foot deep. And this price also includes enclosing the existing pole barn that we have so we can put heat in it so we can protect our pump truck uh [2:51:27, 2:51:47]: our pump trucks or the new VAC trucks we got and the a hundred and fifty foot pole barn, it's to protect all this expensive equipment we've been buying over the last five or six years and we still have more to come. I just want you to know that it's not really use that wears equipment out. [2:51:47, 2:51:48]: is weather. [2:51:50, 2:51:54]: Okay. All right, thank you. Councillor, any questions for uh [2:51:54, 2:52:11]: initiate question. Um so how have we been uh protecting this equipment uh in the past? It's been sitting out in the weather. A lot of it has. Now we we do have some, you know, that's covered, but it's we just have too much equipment and we need to protect it. [2:52:12, 2:52:13]: Thank you. [2:52:13, 2:52:15]: No questions from the council? [2:52:18, 2:52:38]: You got a question, sir, or are we gonna make a motion? I'm just uh no, I just see when we build in facilities like public work facility and other facilities, these types of costs need to be and looked at. And before we go down that line of building the facility, these types of things need to be looked at to consider. [2:52:38, 2:52:58]: Whether or not we're building for future growth and that we can adequately bring in these shelters or whatever else in in in on the property as well when we go down this road. So before we haven't had any provisions to just [2:52:58, 2:53:00]: We just left it out in the weather, that's what we did. [2:53:01, 2:53:21]: No, sir. Well, one of the things that came up as we started to acquire more expensive equipment, we do we noticed that we needed to have an enclosed a shelter over these items. We've had tarps and things of that nature over there. And so we're trying to have permanent heated components like the streets. [2:53:21, 2:53:41]: Sweeper. It's stored out in the elements. It got water in it. So you have pipes and things on that truck that can freeze and break and crack and things like that. So we're building facilities to put these$250,000,$300,000 pieces of equipment so that they're maintained in a warm environment during the wintertime and also they're out of [2:53:41, 2:53:58]: of the elements. And so like Mr. Holsinger said, a lot of times this equipment being out in the elements shortened the life expectancy of this equipment. So as we've acquired, like I said, we've got a second street sweeper now. We've got a back contract. So we want those under and enclosed [2:53:58, 2:54:05]: And shelter where it's out of the elements. It's not being rained on and those things like that. So so [2:54:06, 2:54:26]: How many pieces of equipment is this going to accommodate and then is there room to expand it before we build it? That there's it that was a goal in mind that if we have additional equipment that's purchased in the coming years that we'd have room for. But one of the things like I said, we've got [2:54:26, 2:54:46]: Expensive equipment that we don't want to have exposed to the environment. And also, we don't want if somebody decides they want to break into the facility again like they did previously and load up some of this equipment that's sitting out there. We want to prevent that from happening as well. So the the main thing is trying to extend the life of this. [2:54:45, 2:54:59]: the equipment that we spent uh$450,000 for a VAC truck. We spent$275,000 last year for a street sweeper. So we're trying to prolong the life of those by keeping them out of the environment. [2:55:00, 2:55:20]: So uh again, uh uh this once this is completed, how many pieces of equipment does this accommodate? Well, we've got a a back truck, we got a pump truck, we got uh mowers, we've got tractors, we got street sweepers. Well again, so so we're building the facility, what is the capacity of it? [2:55:20, 2:55:40]: It will be able to handle all of the things and also we'll be able to store other things like parts for the wastewater plant, parts for his lift stations, parts for the water system. So like now we got a bunch of water supplies that are out in the elements covered with tarp down at the maintenance shop. So you got [2:55:40, 2:55:44]: gaskets and things like that inside of those pipes that [2:55:44, 2:56:04]: When they're exposed to the elements, then those start cracking. So when you start using those materials, then they're defective because they've been out an environment and they've been compromised. So we're trying to have facilities where we can put a lot of material that's stored outside and the elements in a safe environment. And my final question. So we bought another street sweeper. Is this good? [2:56:04, 2:56:13]: gonna help us cover that too? Yes. We've got two street suites. So we bought another one. I'm saying in terms of growth in the future, is this going to cover it? Yes, sir. Okay. [2:56:14, 2:56:15]: Ms. Gann, go ahead, please. [2:56:15, 2:56:35]: Thank you. Just for clarification purposes, uh you heard my comment in regards to fund balance earlier. This is water and sewer department fund balance. Yes, ma'am. Is it often that you uh and how do I put this? Do you have a do you normally budget for projects in that in [2:56:35, 2:56:53]: that department or do you always just have a lump sum and you uh go as needed? The m majority of the projects or splice projects and the city's water and sewer has a healthy fund balance that we've been using to uh perform projects that are [2:56:54, 2:57:14]: really been needed. We also using ARPA funds that the CD water and sewer uh and storm water received about five point five million dollars of ARPA funds. So we're doing project as a combination. We did a Smith Barnes, that was C D BG and ARPA. We're doing um I think Burke Street Project that was an ARPA project. So we're using [2:57:14, 2:57:27]: a combination of all the funding that's available to us. And like I said, we have a healthy water and sewer fund balance and this is something that is definitely needed. So we identified that as a project that we need to move forward with. [2:57:27, 2:57:28]: Okay. Do you normally budget? [2:57:29, 2:57:43]: In that department or is it just uh Yes ma'am, we do, but capital projects are in the capital projects budget which the city manager had in in his FY twenty twenty three budget, we submitted the capital projects to him for inclusion in the capital projects budget. [2:57:43, 2:57:49]: Okay. And this was a part of it? Yes, ma'am. All right, thank you. All right, just making sure that it was part of it. Yes, ma'am. [2:57:49, 2:57:54]: Um having said that, uh Mayor, I'd like to make a motion to approve. [2:57:54, 2:58:14]: Um the award, the RFP request number 2022-0017 wastewater treatment plant, pole barn to to diversify constructions of Georgia, and the amount of 1.271650. Funding source is from water and sewer department fund balance. [2:58:14, 2:58:33]: All right. Zero second the motion. Ms. Barber seconds that motion. Any further discussion? If not, all in favor, please indicate. Fantastic. Appreciate it. Thank you. Thank you, gentlemen. All right. What is next is uh says council consideration appoint members to the youth council advisory committee presented by Mr. Washington. And uh [2:58:34, 2:58:44]: Now as you come forward, when I look at when I actually mister Washington, when I looked at this, both these individuals have here Citizens Police Academy Advisory Council on it. [2:58:46, 2:59:06]: I don't know, Miss Holly, you can answer that. I'm just kind of confused. Citizens Police Advisory Council for both these individuals it has on their application. I can respond to that. And below that they ask if there are any other boards that they like to be considered for. And when we reached out to these individuals, they said that they wanted to be considered for the [2:59:05, 2:59:08]: youth would commit. [2:59:10, 2:59:15]: It okay, so if so we we can't appoint to uh [2:59:15, 2:59:21]: Okay, I must I lost how the process goes. A point for the citizens uh police academy, we can't do that. That's uh [2:59:22, 2:59:30]: I don't believe that we have the number yet. We that board calls for twelve individuals. We are not at twelve. [2:59:30, 2:59:32]: So was this a priority one? [2:59:33, 2:59:53]: We asked the individuals, we let them know that they were not ready to appoint the citizens' advisory committee as yet. They have on their applications that they would like to be considered, and they I believe one of them had more than one. And when asked, this was the board they wanted to be considered for. Also, Mayor, our [2:59:53, 2:59:55]: Oh does not. [2:59:57, 3:00:01]: This allows individuals from being members to more than one board. [3:00:02, 3:00:10]: Okay. Yes, sir. Uh considering those facts, um I moved that we [3:00:11, 3:00:21]: table this agenda item until it becomes clear as far as the um the uh advisory board. [3:00:21, 3:00:30]: Okay.
