[0:03:35, 0:03:44]: Into uh twenty twenty-three, more people than ever before, approximately five fifty thousand five hundred and fifty Americans are expected to die from the disease this year. [0:03:44, 0:03:45]: That's a lot. [0:03:46, 0:03:51]: Whereas pancreatic cancer action network mission is to take bold action to improve the lives of everyone. [0:35:25, 0:35:38]: I just wanted to mention Mayor the agendas are available in the table in the lobby if you did not pick one up on your way in. Mayor Ford? Present. Mayor Pro Tem Barber. Present. [0:35:40, 0:35:42]: Councilman Alexander. [0:35:43, 0:35:45]: Councilman Blount. [0:35:46, 0:35:53]: Councilwoman Gantt. Present. Councilman Thomas. Present. Mayor Ford, you have a quorum. Thank you, Madam Kirk. I appreciate that. Um [0:35:54, 0:36:13]: Council, I'll need the uh actually amendment to the agenda and uh like for you to listen to this please. I'd like to need a need a motion to amend the agenda to defer the following items to December eleventh, twenty twenty-three meeting by the applicant's uh request, and that would be item number twelve, thirteen, and fourteen. [0:36:14, 0:36:21]: So moved. Is there a second to that motion? Second. Mr. Blount, second to that motion. All favor, please indicate. [0:36:22, 0:36:40]: I have unanimous decision. Got four votes on that. So items twelve, thirteen, and fourteen will be postponed until the eleventh. Mayor Ford. Yes ma'am. For the record, that is the annexation case for property at 77 and 87 Holloway Road. [0:36:40, 0:37:00]: It is. It is uh deals with the once again annexation case you're right. Uh on the seventy seven eighty seven holiday road, also the comprehensive uh plan movement uh amendment case for the same uh level, same uh property addresses, seventy seven eighty seven Holloway Road, and also the rezoning case for those same properties. Those will be reviewed and uh [0:37:00, 0:37:13]: held held on December eleventh by the applicant's request. So they will not be heard this evening. Uh let's see here. Okay, now I need a motion to the adopt the overall agenda, please. [0:37:15, 0:37:35]: Is there a second? All in favor, please indicate. Okay, thank you very much, unanimous decision on that. Um once again, uh council, you have the adoption of the minutes, the approval of the September eleventh, twenty twenty twenty twenty-three council minutes and also September twenty-sixth work session minutes. If there are no changes, I need a motion to accept those into the record. [0:37:35, 0:37:36]: [2257.0, 2260.0]: So is Mr. Alexander, is there a second? [0:37:41, 0:37:50]: Is there a second? Second. Miss is that you, Ms. Blount? Was that Mr. Ms. Blount? That was you? Yes. Okay, thank you. All right. All in favor, please indicate. [0:37:51, 0:37:53]: [2274.0, 2275.9]: Madam Clerk, do you have any public comments at all? [0:37:59, 0:38:19]: Okay. All right, then we'll on that note we'll go to our ceremonial review. Earlier uh today, roughly at five starting five thirty, we had four proclamations that uh were read into the record. World uh pancreatic cancer day, a small business Saturday uh for twenty twenty-three, and which I understand that should be November. [0:38:19, 0:38:38]: 25th, I believe that date is. A Business Matters Expo and that dealt with the Alpha Cappa Alpha Swordie Cy Alpha Omega chapter here in Henry County. And also a proclamation for the National Native American Indian Month, that we honored that along with um Alaskan natives as well. [0:38:39, 0:38:45]: On that note we'll go to Yes ma'am. Our retiree has arrived. Oh y he has? [0:38:46, 0:39:06]: Okay. Uh all right. Isn't that something? All right, council of uh we have a retired employee that uh I have a award for that was not here earlier. I've just been notified of course that uh he has now arrived, so we'd like to issue that that uh award to him. And so on that note uh I'd like to [0:39:06, 0:39:18]: have a motion just to go ahead and and change that. Put that on the agenda per se. It's a ceremonial type of thing. So that's neither uh uh do this right now in this aspect. Is that right? I need sir. [0:39:19, 0:39:31]: Uh I move to uh alter the agenda to allow for this recognition. Okay. Is there a second? I second. Okay, all favor please indicate. Thank you very much. Okay, so we're seeing [0:39:32, 0:39:35]: Where is it? Council, you can come join me down. [0:39:55, 0:39:56]: Bear with us folks. [0:39:57, 0:39:59]: Well yeah, we recognize [0:40:01, 0:40:02]: Really? [0:40:43, 0:40:58]: Well ladies and gentlemen, if I could I would sing to you, but I'm a lousy seat. Thank you. Put it in an amendment. [0:41:05, 0:41:06]: [2467.6, 2469.2]: So [0:41:11, 0:41:14]: One of the things. [0:41:15, 0:41:20]: Uh I mean one of the shit. [0:41:31, 0:41:38]: Our ladies and gentlemen, this is uh Tommy Mosley, telling the water. [0:41:38, 0:41:45]: Okay. And Tommy's been with City Starkers thirty two years. Right. [0:41:52, 0:42:12]: We've seen a lot of changes in 32 years. And he's retired in this aspect. So we want to honor him in uh being a chance to uh give this back to you before. So 32 years of service, thank you for all the service and dedication that you've given to the city of Stockbridge with Community Connect 1991 to 2023. Congratulations. [0:42:12, 0:42:15]: [2540.8, 2541.7]: Yeah. [0:42:22, 0:42:38]: Who is his wife? His mother. His mother. I'm sorry, I didn't know that. Wait, you wanna come up for a picture, man? Yeah, any relatives you have by the way, are we wives here uh you got a word to lose the press up? No. [0:43:01, 0:43:01]: Where's it? [0:43:06, 0:43:10]: All right. So we're gonna go in three. [0:43:13, 0:43:15]: One two three. [0:43:30, 0:43:32]: Yeah. [0:43:56, 0:44:02]: All right, Council, we're gonna reconvene our meeting. And um [0:44:03, 0:44:19]: We have a presentation and the presentation deals with resise resc revised proc uh provisions to the state zoning procedures law, a presentation on the state of Georgia zoning procedure law regarding new mandated requirements. Mr Anderson, please. [0:44:23, 0:44:26]: Good evening. Um we have a presentation by a consultant. Um [0:44:30, 0:44:45]: for sure be giving us up to date on the recent changes from the two twenty twenty-three uh state of Georgia legislation. Uh some new movement regulations came out and changed the zone proceeding law and we got to do some mandate changes to our use by the Belgian [0:44:46, 0:44:47]: So we've got [0:44:48, 0:44:49]: Okay, thank you. [0:44:52, 0:44:56]: And welcome. Yeah is the mic should the mic should be on. [0:44:56, 0:44:59]: There we go. City Council. [0:44:59, 0:45:01]: Thank you for having me. [0:45:05, 0:45:11]: All right, so what I want to do, uh again, Ryan introduced me Rebecca Kiefer with CPO. [0:45:11, 0:45:12]: Um [0:45:12, 0:45:31]: And what I want to do tonight is walk you through what the changes are that happened at the state level and what that means for you locally here uh at City of Stockbridge. Um identify some recommendations moving forward and then uh get get some direction and then proceed through the text amendment process from there. [0:45:31, 0:45:32]: Okay, thank you. [0:45:32, 0:45:45]: So first uh just very briefly wanted to outline what zoning procedures law is. Essentially this is uh it identifies the uh process that you have to go through if you want to at the local level. [0:45:45, 0:45:50]: uh use your zoning power. So it outlines it does not tell you [0:45:50, 0:45:56]: How to zone, um, kind of what your zoning policy should be. But it does say these are if you are going to zone. [0:45:56, 0:46:06]: These are the minimum uh processes and notification requirements that you that you have to have. And um you've got to have them in your ordinances. [0:46:06, 0:46:26]: And then uh you can do some things above and beyond that, but at a minimum you have to do these various things. Uh it was most recently, and I'll I'll review the amendments, but it was most recently amended in July twenty twenty-two, and and actually there was a an amendment this past legislative session that I'll I'll review what that means too. It did not update. [0:46:26, 0:46:27]: Yeah. [0:46:27, 0:46:33]: uh the procedures section of zoning procedures law but does have implications for uh a land use. [0:46:34, 0:46:41]: Uh so House Bill fourteen oh five was what was uh am adopted in twenty twenty two, effective twenty twenty three. [0:46:42, 0:46:47]: And it did three things. It defined what quasi judicial decisions were. [0:46:47, 0:47:07]: Uh previously there was just a definition for zoning decision and said, and those are effectively rezonings, um, any kind of legislative decisions that you do. So now uh the state has said also the quasi-judicial decisions that you have, variances, special exceptions, those are also subject to uh these state zoning procedures law. [0:47:07, 0:47:18]: It outlines those additional hearing and notice requirements that you have to do for quasi-judicial decisions and then uh also went in and and amended the appeals procedures uh previously. [0:47:19, 0:47:20]: Um it it [0:47:20, 0:47:27]: it was through uh rid of certiori and that went through a a series of kind of adjustments and now it clearly articulates [0:47:27, 0:47:36]: That um zoning decisions are appealed de novo, so um they can uh introduce new information, and quasi-judicial decisions are. [0:47:36, 0:47:41]: Um in the zoning procedures law it indicates writ of sortiori. [0:47:41, 0:47:52]: But there also was a an additional bill um that call calls that um uh you know something different. So that's uh what I'll outline in House Bill nineteen nine sixteen. [0:47:52, 0:47:53]: Yeah. [0:47:54, 0:48:00]: And then uh as a result of that, you're required to adopt these changes uh at the local level. [0:48:00, 0:48:00]: So [0:48:01, 0:48:04]: There are a couple of things that I'll I'll go through in the changes. Um [0:48:05, 0:48:11]: that we've got certain recommendations and and the reason for that is a little bit of ambiguity that was created with these amendments. [0:48:12, 0:48:17]: So you've got what are defined as quaus of judicial decisions, as there's a appeal of administrative decision. [0:48:17, 0:48:22]: special administrative permits, special exceptions. Also variances are defined in that. [0:48:23, 0:48:24]: And conditional uses. [0:48:25, 0:48:36]: Zoning decisions are des defined as rezonings, text amendments, uh I'm s uh special uses and concurrent variances. As you can see, kind of down the middle, there are a couple of things that kind of split the line. [0:48:36, 0:48:52]: of this is the same, but it's just bundled with the rezoning. And so uh what you'll see as a result of our recommendations is that you treat them all the same in that you're meeting both standards so that there's not any kind of um [0:48:52, 0:48:58]: a challenge that could come later if you are supposed to handle something one way. [0:48:58, 0:49:06]: but somebody's appealing it that you should have handled it another way. If we handle them all so that they meet both standards, then you'll be on on good ground either way. [0:49:08, 0:49:18]: So um first I had mentioned that it changed the or it added the definition of quasi judicial um through the definition of quasi judicial officers, boards or agencies. [0:49:18, 0:49:21]: Um and then added to the zoning decision. [0:49:21, 0:49:22]: Uh [0:49:22, 0:49:33]: But prior to this it said if you're m you know, taking an action to approve of zoning decision and this uh amendment also just added if you also repeal or deny it does not not make that a zoning decision. [0:49:34, 0:49:35]: So what [0:49:35, 0:49:42]: As far as the structure of my presentation, I've got kind of a summary of the the changes to zoning procedures law. [0:49:42, 0:49:55]: In the white portion and then in the orange, kind of what we're recommending for for you all to do to to make adjustments. So in the ordinance, we're suggesting that through the text amendment process we can clearly define the actions that are defined. [0:49:56, 0:50:03]: Even if that's to to reference state law, we want to make sure that it is clear what those are and and what has to follow what procedures. [0:50:03, 0:50:07]: And then um in practice the change is is just make sure that [0:50:07, 0:50:18]: um these are are being followed. And if we add anything extra at the local level that is not required at the state level from a due process standpoint, we just want to make sure that we're following that as well. [0:50:19, 0:50:38]: required hearings. Just um there's a specification or kind of a differentiation between the two that for uh zoning decisions only uh one hearing is required whereas per proposed action is required for a uh quasi judicial decision. And so um we would just recommend that you continue to vote on each action individually. [0:50:40, 0:50:47]: Notice requirements. Again, I'm I'm mostly articulating what is different. Um there are notice requirements for zoning decisions as well. [0:50:47, 0:50:52]: But for quasi judicial decisions, since those are what uh have been newly introduced in this legislation. [0:50:53, 0:50:55]: Those require thirty days of notice. [0:50:56, 0:50:59]: And it requires written notification to the property owner. [0:51:00, 0:51:02]: Previously in the code there are there are a lot of ordinances [0:51:03, 0:51:10]: that uh at the local level require, you know, property owner notific notification within three hundred feet, five hundred feet. [0:51:10, 0:51:14]: adjacent um which is what what's in your code. None of that's required at the state level. [0:51:14, 0:51:31]: But this has introduced the requirement to notify the property owner. Most of the time, that is also the applicant, um, or the applicant is is aware through virtue of you know having to sign off on it, but this just mandates that y uh a letter is sent to that property owner. [0:51:33, 0:51:40]: So this is one of the uh biggest changes and um something that will probably uh [0:51:40, 0:51:42]: impact you the least and and I'll explain why. [0:51:43, 0:51:47]: So what this this changed to multifamily, the multifamily um [0:51:48, 0:51:53]: u kind of use rezoning requirements says is that if you as a city [0:51:53, 0:52:03]: are introducing a text amendment that involves allowing a multifamily use in a single family district. So um that's if in your [0:52:05, 0:52:05]: Um [0:52:05, 0:52:25]: your suburban district, you are suburban residential district, you are allowing a multifamily use within there through your text amendment process, then you have to go through these added procedures. Or if you're abolishing in your entire code all single family residential classifications, you have to go through these added that all go through these added requirements. [0:52:25, 0:52:28]: requirements or if you are rezoning [0:52:29, 0:52:31]: Um, only the city, not an applicant initiated. [0:52:32, 0:52:34]: As the city, if you are rezoning property, [0:52:35, 0:52:40]: Um to allow multifamily in a single family district. [0:52:40, 0:52:46]: then you also have to follow these. So um just overall what we would recommend for these is [0:52:46, 0:52:48]: Most of these are uh [0:52:49, 0:52:56]: Things that you would not do likely from a from a policy standpoint. Looking at your comprehensive land, you're gonna protect your single family districts and not [0:52:57, 0:52:58]: uh allow multifamily in them. [0:52:59, 0:53:15]: We have to at least reference the uh state legislation and these added requirements, but it is a lot of extra text that you're not likely gonna going to have to implement. So what we are suggesting is that you adopt these uh added requirements by reference and say [0:53:15, 0:53:18]: If the city were ever to do any one of these three things. [0:53:18, 0:53:27]: then um reference these additional requirements. But because it's not something that you're likely going to do, we would not recommend putting it in the code. And and I'll show you why. [0:53:29, 0:53:42]: So um from a hearing standpoint, if you're gonna do one of those three things, um decisions have to be adopted at two regular meetings that are a minimum of twenty-one days apart. So there's a lot of kind of calendaring that you have to uh navigate. [0:53:43, 0:53:54]: Prior to that two read required adoption, you have to have two additional public hearings, and they have to be held between three and nine months prior to adoption, and then there's a time duration for those. [0:53:55, 0:54:08]: And then there's a notice requirement. So uh you have to post the affected premises. Uh and if there's more than 500 parcels, then you have to post every five hundred feet. So for instance, let's say uh you're going through and doing the text amendment. [0:54:08, 0:54:12]: А то елиминіт сингл фамили і [0:54:12, 0:54:13]: in the code. [0:54:14, 0:54:17]: All the current single family districts would have to be noticed in this manner. [0:54:17, 0:54:19]: And then you've got to do the newspaper ad. [0:54:19, 0:54:27]: Again, those are policies that are you are not likely to do and s so we would recommend just adopting that by reference. So if if sometime there is some [0:54:27, 0:54:42]: legitimate reason why uh you're gonna want to do that. At least there's a notification to staff, an alert that says, hey, if you're gonna process something that is in this manner, you've got all this additional uh these additional requirements. [0:54:44, 0:54:50]: So um moving on from that, there's also a requirement to uh provide [0:54:50, 0:54:51]: Uh an uh [0:54:51, 0:54:55]: written policies and procedures. So those are the that's the criteria. [0:54:55, 0:55:00]: for um you know variances and things to be [0:55:00, 0:55:18]: available to the public um it written. And so right now you can call up the department and and get those written. Um but we would recommend uh kind of providing those at the uh at council meetings so that it's it's just something that's readily available. So we've got to write that into the ordinance and then um [0:55:18, 0:55:23]: adopt that as a pr a practice to offer those printed coun uh copies at council meetings. [0:55:23, 0:55:32]: And those are again the procedures for hearing those variances and uh rezonings, but then also the criteria that you all use to uh assess them. [0:55:33, 0:55:41]: And then the appeals that I had mentioned, um, there's the de novo for appeal for uh review for zoning defici decisions, and then [0:55:42, 0:55:51]: um the appellate review for quasi j judicial decisions. And one thing that uh the zoning procedures law has mandated is that we designate in the ordinance [0:55:52, 0:55:56]: An uh an elected official or designee for quasi judicial appeals. [0:55:57, 0:56:01]: and uh an officer of quasi judicial boards to receive those um [0:56:02, 0:56:03]: Uh those appeals. [0:56:04, 0:56:09]: And then just the effective date. So we wanna uh adopt these and move forward. [0:56:09, 0:56:13]: So then the two other bills that I had mentioned in my presentation, House Bill nine sixteen. [0:56:14, 0:56:23]: Uh it was uh an amendment from this this most current legislative session and it and it actually repeals the writ of sortiory process that we used to process appeals. [0:56:23, 0:56:37]: And now it calls it a petition for review process. Um so anything that is being appealed, uh uh any quasi-judicial decision, i it's just a new process in a new section that is not in the zoning procedures law. [0:56:37, 0:56:44]: Um, but is important because it actually uh the verbiage at least conflicts with zoning procedures law. So we'll wanna reference this this revision. [0:56:46, 0:56:55]: And then this is the land use that I mentioned. So Senate Bill 213 from this past legislative uh session is an amendment to zoning procedures law. [0:56:55, 0:57:15]: And it it did two things. It outlined uh what uh manufactured housing uh and similar types it it's uh that are applicable, and then prohibited local governments from preventing non conforming uh manufactured housing from being replaced. So if there's a lot and it doesn't meet [0:57:15, 0:57:24]: setbacks doesn't meet uh design regulations in the current code, they have to be allowed to replace them. And so we need to uh amend the code to be able to do that as well. [0:57:25, 0:57:26]: Um [0:57:27, 0:57:36]: And so then I will run through uh a series of policy decisions just to kind of um tick tick through for uh you all that we will be [0:57:36, 0:57:38]: uh analyzing so if you have um [0:57:38, 0:57:47]: any any preferences, please please chime in. So for one, in state law there is uh the ability for uh successive applications [0:57:48, 0:57:52]: Um that if they are denied uh for zoning decisions. [0:57:52, 0:58:12]: that they have to effectively have a waiting period of six months. In your code today, that is 12 months. And so you have the ability of dropping down and just doing the state law minimum. So um if there's any preference um to drop down to the six months, I'm happy to hear it and kind of make those adjustments. Otherwise we can continue with the 12 months because it [0:58:12, 0:58:14]: [3494.2, 3496.1]: Just wanted to um note that. [0:58:17, 0:58:28]: Property owner uh notifications. Currently you're doing the adjacent property owner notifications, so we'll just add to that um that the subject property owner has to be notified as well if for some reason they're not a party to it. [0:58:29, 0:58:36]: Um as far as accepting service, we are recommending um mayor and city clerk. [0:58:36, 0:58:42]: uh for that accepting service but can can kind of write in um uh who your preference is. [0:58:44, 0:58:57]: Currently, um you've got a list of allowed variances that limits your flexibility a little bit. And so we would be looking at identifying a list of prohibited variances that um [0:58:57, 0:59:01]: People cannot request and but then opening the door to [0:59:01, 0:59:05]: Um what additional variance is subject to that criteria? [0:59:05, 0:59:07]: Um that hardship criteria. [0:59:08, 0:59:13]: We'll look at uh a waiver process that varies a little bit from a variance process in that. [0:59:14, 0:59:20]: uh you do not necessarily have to meet a uh the barrier of a hardship. [0:59:20, 0:59:32]: But uh it would be to design standards and things where you're able to provide alternative designs, but maybe not meet the letter of the code. And so that would be um something that we would propose in the amendments. [0:59:33, 0:59:48]: Consider uh reviewing Platz as an administrative process and then consider implementing a community zoning information meeting, which is applicant driven, kind of outside of the city where the the applicant has to um present and and provide minutes from from their meeting. [0:59:50, 0:59:59]: And then um just to let you know the adoption schedule, um uh probably in December uh at uh planning. [0:59:59, 1:00:05]: We would uh look to adopt the twenty twenty-four calendar that is consistent with this thirty-day notification process. [1:00:05, 1:00:07]: And um [1:00:07, 1:00:12]: then bring before planning commission uh december twenty first the [1:00:12, 1:00:20]: Uh text amendment to be heard and then Marin City Council on January 9th for adoption all of these redlined uh text amendments. [1:00:20, 1:00:29]: So with that I am ready for questions if you've got any. Well thank you for the briefing. I appreciate that. Um Mr. Washington and Mr. Gardner, could you come to the mic, please? To the podium. [1:00:34, 1:00:54]: Ma'am, I n you you probably have some questions coming up as well. I just want to double check. We have a couple I mean, I see the adoption schedule here, so I'm I'm pretty sure this answers my question. Otherwise we have rezoning cases before us tonight. So obviously this these changes we haven't officially adopted even though it's been passed in the legislature. With those this will don't doesn't take effect with anything we do tonight. Is that correct? [1:00:54, 1:00:55]: Right. [1:00:56, 1:01:02]: Okay. That's why I'm double check that. All right. Council, any questions you may have? Gentlemen, please stand by just in case. Questions? [1:01:03, 1:01:05]: Ms. Barber, you have a question? Go right ahead, please. [1:01:06, 1:01:12]: For clarity, um, with the question the mayor just asked, we do have a public hearing on the agenda. [1:01:12, 1:01:15]: One specifically the Valley Hill Road. [1:01:15, 1:01:16]: Um [1:01:16, 1:01:19]: How does this affect the decision? [1:01:19, 1:01:20]: That the council may [1:01:21, 1:01:22]: Today regarding [1:01:22, 1:01:23]: that public hearing. [1:01:24, 1:01:25]: Yeah, so we had already [1:01:26, 1:01:35]: In reviewing this, we didn't have any conflicts with the legislation that needed to be proposed that the city was going to do with Valley Hill. I can't hear you. [1:01:35, 1:01:41]: It doesn't. We didn't have we didn't find that it did. Counsel, if I'm wrong, let me know, please. [1:01:45, 1:01:48]: Can you provide a full explanation? [1:01:50, 1:01:55]: The proposed changes that were up here that they said that needed to be taken into consideration for our zoning code. [1:01:55, 1:02:10]: Our zoning code is meeting that with the Valley Hill requirements. So there's no need for there to be any adjustment to the Valley Hill requirements if you all decide what you want to do with them. In other words, everything that has been proposed in our [1:02:11, 1:02:30]: Many of the things we kind of caught before this legislation was even passed. And so there'll be some tweaks, but they're not major tweaks. As she noted those five the six points that would need to be done would be tweaks, not major rewrites of all the legislation that we have. And so it doesn't affect enshort the Valley Hill or any of the decisions that are on the docket today. [1:02:30, 1:02:31]: Thank you, sir. [1:02:32, 1:02:35]: If I'm please correct me if I'm Any other questions, Council? [1:02:35, 1:02:37]: Yes, sir. Go ahead, please. [1:02:38, 1:02:43]: I want to thank you again for your presentation and uh I I need a little c clarity myself. [1:02:43, 1:02:48]: Uh when you mentioned uh Senate Bill two thirteen, uh the new zoning law. [1:02:49, 1:03:01]: You use the word conformity. Um, and I'm trying to get a better understanding. And I think you use an example if a property owner had a vacant piece of property and wanted to come in and build [1:03:02, 1:03:22]: they could not just come in and bill. It has to meet the same conformity as to what is already existing in that particular subdivision. And and the reason I asked, uh there's an issue currently in a subdivision and uh the property owner is trying to come in and bill [1:03:23, 1:03:24]: But [1:03:24, 1:03:29]: He wants to build something that is not [1:03:29, 1:03:35]: uh similar to what's there and I I think the city did deny [1:03:35, 1:03:55]: But now and I know there's a a a homeowner here and I wanted her to hear this because this is something that we had talked about. So can you reiterate? Thank you for the opportunity to clarify. Yes, this is for um things that existed well, well before today, um and for those uses specifically, not for not for any use, if not any use that's non-conforming. [1:03:55, 1:04:04]: conforming, any structure that's nonconforming. If the specific uses that that meet the definition and and a and a lot of that goes to interpretation. [1:04:04, 1:04:05]: Um [1:04:05, 1:04:07]: that we'd have to consider on a case by case basis. [1:04:08, 1:04:20]: Those are the situations that are afforded this uh ability to r to replace. It's not instituting something brand new that is not conforming to the current code. Anything brand new has to comply with the current code. [1:04:21, 1:04:22]: Thank you. [1:04:22, 1:04:23]: I knew it back there. [1:04:23, 1:04:31]: All right, no problem. Mr. Blount, you have a question? Yeah, I'm tr um looking at the prohibitions and I think it was you said was it Senate Bill two thirteen? [1:04:32, 1:04:34]: That talked about the trailer Holmes. Yes. [1:04:35, 1:04:35]: Um [1:04:36, 1:04:38]: If a developer comes in [1:04:38, 1:04:42]: for a long term scope of those properties uh [1:04:43, 1:04:45]: When you have trailer homes and a certain amount of acreage [1:04:47, 1:04:51]: And that developer wants to continue to buy, buy, buy and hold, hold, hold. [1:04:52, 1:04:55]: Is there a percentage in there of [1:04:55, 1:05:05]: homeowners that are still left, does that bills those prohibitions still stand for the rest of the community, even if that even if over fifty percent of that community is gone. [1:05:06, 1:05:09]: And and do the structures still exist? Are they currently being used? [1:05:10, 1:05:16]: Well at that point it doesn't matter because it because it's it's it's in a uh other ownership and not for that use. [1:05:16, 1:05:36]: Oh okay. So i if it's a a different use it's not likely, but we can we can while we're working on the red line text amendments, we can look at some specific cases and and try and understand how they how but you see what I'm saying, right? Right. Yeah. You know, because that's it's the same concept that happened what happened happens in communities, but [1:05:36, 1:05:47]: But it would be the same concept. But with those provisions, though prohibitions that are in the Senate Bill two thirteen, w I was just trying to figure out what percentage would that be nullified or how do you [1:05:48, 1:06:08]: Uh there is not a percentage that I'm familiar with, but I I can look at a a specific example and and just to get a better understanding for how it applies. Yeah, it's gotta be something in that bill because if you get say for instance for instance you got fifty homes and three left, now you got all this acreage that's been bought up, then that bill obviously can't [1:06:08, 1:06:14]: stand the way it's the way it's presented now. There has to be some kind of something in there that says [1:06:15, 1:06:29]: the right for the people that are wanting to develop the rest of the land. Well and certainly if the if the owner wants to do something different, this does not prohibit the landowner from doing something different. It just preserves rights of the the landowner or the user. [1:06:30, 1:06:50]: So it preserves the rights of the landowner that if he wants to rebuild, he can rebuild that instead of moving on. More than likely. Yeah, yeah. That that's if somebody wants to continue or wants to replace it, if there's not a desire to [1:06:50, 1:06:53]: to replace it then then the bill does not [1:06:53, 1:06:55]: I is not applicable. [1:06:55, 1:06:56]: Okay, got you. [1:06:56, 1:06:59]: Any other questions, Council? Go ahead, Ms uh Ms. Cant. [1:06:59, 1:07:08]: Um I don't have a question. I just have a comment. I did see here on the policy decisions that one of the things that mayor and council [1:07:08, 1:07:18]: can consider or should consider is community zoning information meetings, applicant driven. And I think that's something that we really need um [1:07:19, 1:07:21]: To put in our policy. [1:07:21, 1:07:26]: as a a requirement that we require them to have a community zoning information meeting. [1:07:26, 1:07:27]: I think that would be good. [1:07:27, 1:07:31]: without us having there are some developers who do it already. [1:07:31, 1:07:34]: they go out and they reach out to the community and people who are [1:07:34, 1:07:42]: Um maybe for or against. Um oftentimes it's against, but um I think it would do [1:07:43, 1:08:00]: uh a better of service and allow notice and allow more communication and dialogue between that developer and the community. So that was the last bullet point here under the policy decisions. And I think we should consider that as part of our policy. Okay. [1:08:01, 1:08:21]: Any other questions, concerns for the council? So since this deals with legislative uh process updates and changes that are done by at the Georgia State Capitol and the timeline given here, I would imagine we need a motion to accept this responsibility and have this done by the timeline so we're in compliance here at the at the municipality. [1:08:20, 1:08:30]: Municipality. So if that's the case, uh need a motion to accept this, along with maybe potentially Ms. Gantt, your additional comment. [1:08:30, 1:08:33]: And uh see what what the council wants to do here. Mayor. Yes, ma'am. [1:08:34, 1:08:45]: I move that we accept the revised provisions to the state zoning procedure law, in addition that we also require the community zoning information meetings by the applicant. [1:08:46, 1:08:47]: Okay, is there a second that motion? [1:08:49, 1:08:54]: Is there a second to the motion? Yes, sir. Ms. Mr. Thomas Secondette. All in favor, please indicate. [1:08:55, 1:08:59]: Shenam's decision. Okay. Thank you very much. Appreciate it. Thank you very much. Thank you. Thank you. [1:09:01, 1:09:16]: What's next is we at the twenty twenty two auditors discussion analys analysis of the annual comprehensive financial report from Malden and Jenkins. Mr. Gardner and Hope Pendergrass and Malden and Jenkins, please. Welcome. [1:09:22, 1:09:32]: Good evening. How are you all doing? All just fine. Thank you for the opportunity to come and speak with you all tonight. I see that you have a very full agenda, so I'm gonna keep my remarks very brief. [1:09:32, 1:09:52]: Um we do have the 2022 audits. My understanding that's been provided to you all. Um highlights include that we issued an unmodified opinion. That's a clean opinion, that's the best that you can get. So kudos to management and the council for its leadership in that avenue. Um the city does prepare an annual comprehensive. [1:09:52, 1:09:58]: Financial report, which means that you all have taken the initiative to go above and beyond the basic requirement. [1:09:59, 1:10:19]: And submit your financial statements for a national award through the Government Finance Officers Association. You all have received this re award in previous years and your prior year certificate is included in the current year audit. And we have um no doubts that you all will continue to receive this certificate again for your 2022. [1:10:19, 1:10:20]: Um ac for. [1:10:21, 1:10:21]: Um [1:10:22, 1:10:42]: Other highlights include the fact that you all have fund balance in your general fund of about four point five million. Um your utility funds are holding steady. So um as far as that goes, we did have um a few findings in regard to uh material audit adjustments. That's something that's very that it's [1:10:42, 1:11:01]: It's pretty routine. Um Maldon and Jenkins audits about six hundred and fifty governments throughout the southeast. And so um whenever we make material audit adjustments, we do have to report those as a finding. That's nothing necessarily indicative of misappropriation. It's just sometimes you have to dot the I's across the T's and us accountants kinda geek out on that stuff. [1:11:01, 1:11:02]: So [1:11:02, 1:11:13]: Um, we did have some recommendations, those have been provided to management, but I don't see anything within the findings that can't be easily corrected in your 2023 year. [1:11:13, 1:11:18]: So that is my m my quick synopsis and I'll be happy to entertain any questions should you have them. [1:11:18, 1:11:38]: Well, thank you for that. Appreciate it. Council, what kind of questions do you have? Mr. Mr. Um Alexander, please go ahead. Thank you so much for your presentation. And uh you've been before us numerous times and you've been you've done the audit. You've done a fine job in completing the audit. I think in previous indications you had indicated you all uh audited some. [1:11:38, 1:11:41]: three hundred cities in Georgia, is that correct? [1:11:41, 1:11:55]: Um, I have to go back and look and see where we are as far as the number of of cities in Georgia, but um we we just keep up with it as a total. That includes six fifty includes cities, counties, boards of education. They're out our um southeast footprint. [1:11:56, 1:12:16]: Okay, so pretty much you do I guess is the commissions and uh school boards and everything. Yes, sir. A little bit of everything. Actually, I think you made the statement that the city was pretty strong in terms of where you were, uh in terms of uh what you had seen in other areas, especially with us having a reserve fund and then us um [1:12:16, 1:12:36]: been operating as we have been operating uh previously. Uh certainly we incorporated a police department this year, which kind of it certainly impacted the uh overall expenses. But what I heard from voters over over and over again during that time was that they wanted to be safe and certainly uh [1:12:36, 1:12:56]: Voters should understand that's uh why we had that's why we implemented a millage. The millage is at the lowest rate divisible, which was 3.77 percent. Previously, we had not had uh a millage. So certainly um those numbers still remain uh inefficient. [1:12:56, 1:13:02]: a stronger p in a strong s in a strong position uh with reserve funds uh available to the city. [1:13:05, 1:13:08]: Is that a question? Yes. Is there we remain in a strong position? [1:13:09, 1:13:09]: Um [1:13:10, 1:13:28]: Your fund balance is certainly not as strong as it has been, but like you said, the city has undertaking some initiatives in the current year that, you know, hopefully going forward, you know, they won't be as uh sustained of an expenditure up front. Anytime you implement new initiatives, you know, there's gonna be some upfront cost. Mm-hmm. So [1:13:28, 1:13:29]: Um [1:13:30, 1:13:34]: Does that answer your question? Yeah, I'd like to ask Mr. Gardner to come to the podium. [1:13:42, 1:14:02]: I think this is the time of the year that the property tax generally come in to the city and then that changes uh those numbers tr tremendously as we go through the year. We're taking down the amount and then bam the property taxes hit all at one time. Explain uh that process again. [1:14:02, 1:14:20]: we're sitting at that number today, uh which we are, but certainly we with the property taxes coming in, which is pretty much the majority, uh uh which is a large sum of the monies that we take in to balance our general fund. Talk about that. [1:14:20, 1:14:40]: Yes, sir. So your property tax is still not your number one source of resources. Lost. So your sales taxes at about twelve million. Um will estimate it to be that with the fact that of the population growth. But your property tax will come in, it will be citrical as it relates to your overall budget up financial operations throughout the year. [1:14:40, 1:15:00]: So for cities whose budget starts July 1 to June 30th, you know, they see that hit the budget in June in November, and then it used to carry them over from November to June, and then June back to November. Ours will obviously be January, and then in the month. [1:15:00, 1:15:13]: months of November and December, we'll see that influx. It'll then help us in the current year, but also project us into the next year, just like in the fiscal year of like Henry County, which is on a July to June. So it'll become cyclical every year. [1:15:14, 1:15:34]: And so for us that's that's uh one way of being good. The good part about it is for us being on the calendar years, obviously you start in the new year and you're able to then track throughout the year. So it'll help that that will give us the obviously the boost that we need, but also um one of the things I'm gonna show in the presentation I'll gonna give later on is [1:15:35, 1:15:40]: As I mentioned to this council, this city is fast headed towards fifty plus thousand people. [1:15:41, 1:15:43]: So you gotta keep that in mind. [1:15:43, 1:15:44]: Right. Um [1:15:44, 1:15:47]: I literally spoke to a colleague, um [1:15:47, 1:15:49]: From a town in North Carolina. [1:15:49, 1:15:53]: And in nineteen ninety they were the same size as as this city. [1:15:53, 1:16:13]: About 4,000, 3,000 people. They're now 80,000. Right? Um, but obviously, yes. So as time go along, you'll be looking at how do you adjust up or down based on what happens in the economy. Your property tax tend to be more stable of your revenues. However, I will say that you just lost. [1:16:13, 1:16:22]: Has been our loss overall throughout the state has actually been good even through COVID, because a lot of people stayed home, but they also went and they [1:16:23, 1:16:37]: spent money online and they did stuff around their houses. So they didn't stay idle for a lot of folks. And apparently that we didn't see a huge dip. But your property tax will be a strong a strong point moving the city forward. The city won't no longer operate under one primary source. [1:16:38, 1:16:50]: And so what dollar amount should we expect to hit for this particular uh number that we're expecting? So looking at it,'cause I was talking to a resident uh today, not last week. [1:16:50, 1:16:56]: Uh uh property tax will come in somewhere around the sixteenth was between the sixteenth and and Thanksgiving. [1:16:57, 1:17:17]: Um on an annual basis it usually hits your budget around it hits um my escrow and I looked even at my old house around the six the thirteenth or the sixteenth of November is when my escrow company pays in. Obviously most of our homeowners are probably still on escrow's. Um some already have paid for their home. [1:17:17, 1:17:23]: and obviously they'll bank that throughout the year and pay it. Um but that'll hit somewhere around [1:17:23, 1:17:43]: Around the year. Right. How much should we be using? So we're we're estimating overall rent all collected somewhere around six point seven. So you probably see somewhere between five and six million that'll hit us within the next week or two. Okay. From Henry County tax assessors. From the Henry County tax assessor, that money should come in uh to um to help to fund what we have. [1:17:43, 1:17:46]: we got going on with the city operations, correct? [1:17:46, 1:17:54]: Yep, and like I said, it becomes centrical. Every year you'll see that happening a on a yellow basis moving forward. Thank you. [1:17:54, 1:18:14]: I just wanna add to that discussion and then the fact that because your property tax is gonna come in right around your year in and right before it going forward, you'll be essentially at your fattest, healthiest at twelve thirty one probably, because that's when you're gonna get the bulk of your tax revenues, whereas your expenditures are, you know, flat over the [1:18:14, 1:18:20]: the year you're gonna have this big jump. So you're gonna look really healthy at twelve thirty one and you're gonna need to consider that. [1:18:20, 1:18:39]: for your initiatives for the next year. Whereas if you were like a six thirty entity, they're they're leanest at their year end because it's right before their property taxes start coming in. So that's just some context that you all will need to consider when you're looking at the audit going forward because again, you'll be your fattest from a health standpoint. [1:18:40, 1:18:41]: at your year in. [1:18:42, 1:18:52]: So basically what you're saying is today is we're looking at now today we'd be adding that six point seven million dollars to uh the fund bal the current fund balance, correct? [1:18:53, 1:19:12]: Yeah, that'll be that'll be utilized for your current fund balance and the balance off your current FY twenty three. And then it carries into the next year and and as Right, but I'm saying the number in the that's why it would be so fat because it would be that is correct. Uh but basically if it's four point six plus six point seven, it'd be over eleven million dollars. [1:19:12, 1:19:30]: But that'll be obviously that'll still be temporary. Of course it's it's being used and but that's what the number would be. So we want to compare apples to apples because that's what we've been doing uh in the past, so people can understand uh the direction that we're going in and and where we're going to. So I certainly uh do appreciate that. Thank you. [1:19:31, 1:19:43]: Yes, sir. And and as I said, it you remember, you will get that high and then throughout the year as we go, we'll rely that you pay off those those debts over that time you'll be relying on your sales tax that'll come in monthly. [1:19:44, 1:20:04]: Some property tax will come in behind that. Obviously for those folks who are not on escrow, they tend to pay a little later or throughout the year. So that'll continue to trickle in, but not at the same volume that you'll see. Okay, one one one final question. So that everybody understands, I made this this conversation has been centered around the property tax. It really is you for important for you to understand. [1:20:04, 1:20:24]: Understand, my property tax is$5,052 this year.$3,500 of that is the school board tax. So you have to understand when we're talking about what we implemented, the school board has a 23 mil tax that everybody pays until you're 62 and it kind of goes down at [1:20:24, 1:20:44]: At that time, the city implemented a millage of 3.77. I said 23 for the school board and 3.77 for uh the city. So understanding we certainly want to do everything that we can to be uh to minimize the impact to you, but the real financial impact each and every year that we're seeing [1:20:44, 1:20:53]: suffering with these increases in the property value starts with the school board, then it trickles down to the county, and then it comes uh to us. So thank you. [1:20:54, 1:20:56]: You know the comments from the council? [1:20:57, 1:21:17]: I do. Yes I'm sorry. I just wanna I wanna make sure preference to what we got. Okay, go ahead. Go ahead, please. Uh the city's miller's rate is at three point seven seven, but I think everyone needs to be that got annexed then look at your twenty twenty two and your twenty twenty-three. What the city did was you were already paying one point something miller's rate for your police. [1:21:17, 1:21:26]: that came into the city's three point seven seven. So in essence, the city only actually truly increased from a military standpoint about one point something on it. [1:21:27, 1:21:47]: Right. So fo that's something that the city citizens did not understand is that they were already paying Henry County for public safety, which was about one point nine on average home about two hundred dollars. So basically uh we didn't add the three point seven seven as the city manager said, we added about half of that uh to what what you were already [1:21:47, 1:21:54]: already paying for public safety, but you got sixty police officers uh patrolling the Stockbridge streets now. Thank you. [1:21:55, 1:21:56]: Ms. Barber, go ahead, please. [1:21:56, 1:22:00]: Um, so and forgive me, I'm still just [1:22:00, 1:22:03]: Looking through the table of contents of [1:22:03, 1:22:04]: This information. [1:22:05, 1:22:06]: The engagement letter. [1:22:06, 1:22:10]: Is that something that's a part of this report? No ma'am. [1:22:10, 1:22:11]: No. [1:22:11, 1:22:16]: No ma'am. Okay, I'd like to request a copy of the engagement letter and the reason being is [1:22:16, 1:22:24]: I want to know if you all took a look at the general ledger transactions for budget amendments and any adjustments. [1:22:25, 1:22:27]: Would I be able to find that? [1:22:27, 1:22:28]: in this financial report. [1:22:29, 1:22:32]: There are budgets to actual schedules in the report, yes ma'am? [1:22:33, 1:22:39]: The schedules. Yes, ma'am. There are budget to actual schedules. So they're like there's an analysis in the report. [1:22:40, 1:22:42]: Of the budget to actual for the general fund. [1:22:43, 1:22:47]: your ARPA fund and then some of your smaller governmental funds. [1:22:47, 1:22:49]: Okay, but any of the [1:22:50, 1:22:50]: Um [1:22:51, 1:22:52]: Adjustments. [1:22:52, 1:22:54]: to any of the general ledgers. [1:22:55, 1:22:56]: Where would I find that? [1:22:56, 1:23:08]: The adjustments to the budget or the adjustments to the general ledger? To the general ledgers. Oh the aud like audit adjustments or okay. Um yeah, management has a copy of the audit adjustments. [1:23:08, 1:23:09]: Okay, I'd like a [1:23:09, 1:23:12]: I'd like to request a copy of that as well. [1:23:14, 1:23:15]: Please. [1:23:16, 1:23:18]: Is that something we need to vote on here? [1:23:18, 1:23:21]: [5001.4, 5001.8]: Yeah. [1:23:22, 1:23:24]: I was gonna answer the question, but go ahead, sir. What's on it? [1:23:24, 1:23:25]: Uh well uh [1:23:26, 1:23:28]: Mayor Pro Tem, are you finished? Because [1:23:31, 1:23:34]: You said that management has a copy. [1:23:35, 1:23:38]: Correct. Of the audit adjustments, yeah. Right. [1:23:39, 1:23:41]: I'm wondering why the council does not have that. [1:23:42, 1:23:44]: I mean that's the [1:23:44, 1:23:50]: protocol at all the governments that we go to, we provide management with a copy of the audit adjustments. [1:23:50, 1:23:53]: And then they distribute them to their governing body. [1:23:54, 1:23:57]: as requested. I don't think I've ever included audit adjustments. [1:23:58, 1:24:03]: All right. So I guess that's the question for you, Mr. Gardner. Please. [1:24:05, 1:24:08]: If if I haven't sent them I can send them tomorrow. [1:24:12, 1:24:16]: I will make sure that everybody gets a copy of one the engagement letter. [1:24:16, 1:24:20]: And also a copy of any of the um [1:24:21, 1:24:38]: Audit adjustments. But as I think the auditor said, that's typically something that happens from an operationalist well working with with finances that finance department throughout the state, school boards, whoever they work for, um that happens. But if co if counsel wishes to have a copy of that, we'll provide that. So everything that [1:24:39, 1:24:42]: Malden and Jenkins gave to management. [1:24:43, 1:24:47]: I like to see it too. We will provide whatever they give to us to you guys. Yes, ma'am Thank you. You're welcome. [1:24:49, 1:24:50]: Yes, ma'am, go ahead, please. [1:24:50, 1:25:10]: Can you explain exactly what audit adjustments are so everyone can get a a better idea? Um uh especially if we haven't done it in this way before, just kinda explain it so that everyone can understand what's going on. Sure. So management records the activities of the city in a general ledger. [1:25:10, 1:25:20]: which is essentially the books and records of your financial transactions. They present the ending numbers to us to audit. [1:25:20, 1:25:29]: If we um as a as part of our audit process, if we determine that a number needs to be corrected, we post what's called an audit adjustment. [1:25:29, 1:25:36]: And so those adjustments are provided to management and accepted as part of the finalization of the audit process. [1:25:36, 1:25:56]: So, you know, sometimes it's like, hey, we had this invoice that came in and when we're auditing, they put it in the twenty twenty-three year, which is the year in which it was paid, but it was really something that related to the twenty twenty-two year. So we were recording accounts payable at twelve thirty-one twenty-two to say, hey, the city owed this as of [1:25:56, 1:25:59]: [5159.5, 5162.3]: So that would that would be an example of an audit adjustment. [1:26:03, 1:26:04]: Thank you. Mm-hmm. [1:26:05, 1:26:07]: Any other questions from the council? [1:26:08, 1:26:19]: Thank you. This is a presentation. So otherwise um we did Mr. Gardner got a directive. I don't know if it's necessary to make a vote on that. You got a directive in reference to what we what you indicated you're gonna get to the council. [1:26:20, 1:26:20]: Uh [1:26:24, 1:26:42]: Right right, right, right. I'm just right, I just thought. Okay. So otherwise we you have to guidance on that. Uh so um so we'll move on uh to the next item'cause no need to uh have a vote on this or at this point in this aspect because there's a document obviously we'll be getting [1:26:44, 1:26:44]: Okay. [1:26:45, 1:26:49]: Consent agenda. Uh council consideration approved the use of mural matters conference [1:26:50, 1:26:57]: A center ballroom for the youth council holiday event on december sixteenth of twenty twenty three. Um [1:26:59, 1:27:05]: Miss uh Gordine, I don't know if she's here to make the it's on the consent agenda, so I don't know if any questions that the council may have on approving this. [1:27:07, 1:27:15]: We we generally you just vote on the Okay, well okay I need a motion force vote. So m so I second. Okay, from Alazar to Gantt. All favor, please indicate. [1:27:16, 1:27:17]: Thank you very much. [1:27:17, 1:27:18]: Thank you. Thank you. [1:27:19, 1:27:22]: Oh, there okay, there you are. No no problem. You're good to go. [1:27:22, 1:27:25]: I council. I had um [1:27:25, 1:27:32]: Please excuse me, I missed something a little earlier and I wanna let you know that number eighteen, item number eighteen was actually a new business item. [1:27:33, 1:27:53]: That deal with the council review of consideration for property tax, homestead exemption plan, and ordinance for 2025. Mr. Ed Wall is here for that. So before you get started, I want to make sure that you're all right with us amending the agenda to move from item uh this new business item from item 18 all the way and have this right now before we go into public. [1:27:53, 1:27:59]: hearing mayor so moved okay ms Gantt second over here ms mr Blount second that all in favor please indicate [1:28:00, 1:28:03]: Okay. Discussion. Okay, one what okay. [1:28:03, 1:28:06]: Question. Thank you, sir. Mayor Ford. Yes, ma'am. [1:28:07, 1:28:12]: So I'm concerned because all of these major [1:28:13, 1:28:16]: Items that are coming before the council right now. [1:28:16, 1:28:18]: including this annual [1:28:19, 1:28:19]: Audit. [1:28:20, 1:28:21]: We just got it. [1:28:22, 1:28:23]: When we started the meeting. [1:28:23, 1:28:27]: I haven't had an opportunity to review any of this, okay, including [1:28:28, 1:28:30]: Um the homestead exemptions. [1:28:30, 1:28:32]: I've been waiting for staff to send me. [1:28:33, 1:28:34]: The information. [1:28:35, 1:28:36]: I just got it. [1:28:36, 1:28:43]: Right now. Okay. And if I'm expected to vote on anything, I'm not because I haven't re reviewed anything. All right. [1:28:43, 1:29:02]: Well, we had a motion on the floor to to uh uh put this movement from eighteen to now for Mr. Wall one second, um one second we had a motion on the floor and it was uh set made and seconded, I believe from uh Ms. Gantt to Mr. Blount. All right. All in favor of the motion, please indicate. All right. And and Miss uh Barber, you either oppose or sustain one or the other. [1:29:03, 1:29:08]: I approve amending the agenda to add this item. [1:29:09, 1:29:11]: for discussion or presentation. [1:29:11, 1:29:13]: But I will not vote. [1:29:13, 1:29:26]: Okay, sir. On anything. Okay, so otherwise you're all right. It's announced decision to put this on the agenda now. Move it up on the agenda now. It's announced decision. All right, Mr. Wall, it's yours. Real quick, Matt. Go ahead, please. Um, please speak into the mic as well, sir. [1:29:26, 1:29:46]: Yes. Um Councilmember Barber is correct that yes, we just handed this out. Um as you know, we've been working on it um and tried to get it here today uh early. That's uh my fault. But you please take the presentation. You don't have to actually vote on it today. We still actually have time for you to actually get the information. Uh [1:29:46, 1:30:06]: Um was the word I'm looking for. Gather your thoughts on it, send back questions to us. We still have time in Rich to actually send this to our legislators to be put on the schedule at the General Assembly to make things happen. So our goal is to present this information to you, get some feedback. [1:30:06, 1:30:07]: Because obviously [1:30:08, 1:30:25]: Everybody's gonna have a different view of how what what they want to see in the cafeteria plan. We can then once get consensus bring this back to you guys and then have a final vote on that before the end of the fiscal year. So this is actually informational, not not for a vo not for a vote on the year. Obviously you just air is gonna present. [1:30:26, 1:30:28]: You guys divulge the information? [1:30:29, 1:30:38]: Give us some feedback and then we'll move with what we get back from from the council. All right. Thank you. Mayor Ford. Yes, ma'am. May I ask that this item be added to the end of the agenda? [1:30:38, 1:30:54]: We've got a room full of residents here who are obviously here for a public hearing. You agreed to that motion. Matter of fact, it's an absolute decision to move. Did you say when we would add this item? Yes, right now. Okay. I think it well then [1:30:55, 1:30:57]: I rescind my vote then. [1:30:57, 1:31:17]: I will abstain. I'd rather have added to the end of the agenda. Okay. All right. So that the people who are here for the public hearing. Mayor Prozamp, got it. No problem. Stand up. Thank you. Um I guess on the legal aspect, okay, we got we had a motion. It wasn't that she wants to rescind that, so to abstain. So it's four zero one. I imagine we can legally do that. We can change that. [1:31:17, 1:31:17]: Correct? [1:31:20, 1:31:24]: No, no, no. Well, she says she just wants to take a v she wants to sustain it because in this aspect [1:31:25, 1:31:30]: She vo originally voted to to have this attitude to j move it up. Okay, now she wants to [1:31:31, 1:31:33]: Right. [1:31:35, 1:31:36]: Supposed to second. [1:31:37, 1:31:41]: For for for her. I mean everybody else is agrees. [1:31:42, 1:31:42]: Okay. [1:31:43, 1:31:47]: Okay. Thank you, sir. What's your comment, sir? Mayor for the council. [1:31:48, 1:32:01]: The fact that this is just merely a presentation, there's no vote on this. When it was presented, it it appeared that we would entertain a vote, but the fact that we're just [1:32:01, 1:32:02]: in attaining [1:32:03, 1:32:04]: The presentation [1:32:05, 1:32:25]: I think Mayor Pro Tem is correct. We have all these folks here. I really think we should entertain the public hearing and then um entertain this presentation uh from Mr. Wall. So I rescind my vote as well. Okay, if you resent Okay, there's still three votes indicating that we wanna we wanna go. [1:32:25, 1:32:27]: Mayor Ford. Yes sir. [1:32:28, 1:32:29]: I would hope [1:32:30, 1:32:48]: That another council person would rescind as well, because let's be respectful of these folks that are here tonight for this public hearing. The fact that we're not voting on this and this is just a presentation and we just received it, just that fact alone. [1:32:48, 1:32:51]: We should have a little bit more respect for these citizens. [1:32:52, 1:32:56]: We'll we'll get we'll go get hope that at least one other council person [1:33:00, 1:33:11]: I would hope that one other council person will have the respect and the dignity to rescind that vote as well. So and a and Mr. Wall, it has nothing to do with you. [1:33:12, 1:33:23]: Um has nothing to do with you but the fact that these citizens have been here for a while. And again, we just received this. And so I just think it's just out of respect that we should we should do just that. [1:33:25, 1:33:25]: Okay. [1:33:26, 1:33:27]: Yes, sir. [1:33:28, 1:33:31]: Yeah, the the agenda says it's for um [1:33:32, 1:33:43]: review and consideration of the property tax exemption, Homestate exemption plan and ordinance. Because the part consideration mean that it it could be a voting item tonight. [1:33:43, 1:33:46]: Uh one of the things that I would hope this council would do [1:33:47, 1:34:07]: Uh, and that's in respect to all the citizens here in City of Stockbridge, is that we look at um this as a way of saying that um we have um so many citizens that came into the city of Stockbridge that are now uh that I got so many calls in the day that we call. [1:34:07, 1:34:08]: [5648.5, 5654.3]: When they came into the city of Stockbridge, they came into the city of Stockbridge opening their pocketbooks because of this. [1:34:15, 1:34:20]: And this is important for s thousands of citizens right now that's been annexed into the city. [1:34:21, 1:34:22]: So I don't I don't [1:34:23, 1:34:30]: It's not a disrespect to anyone in the audience on procedurally what we do up here. That's not a disrespect. [1:34:30, 1:34:33]: Із адес піс хі. [1:34:34, 1:34:51]: reflects thousands of citizens that need to understand that there is relief for taxes. When you have people that are on fixed income and all of these people that are sitting here uh looking at it that that are wondering what is gonna happen because we gave some people [1:34:51, 1:34:55]: That got annexed into the city a tax bill that they didn't have. [1:34:55, 1:35:08]: And that tax bill came for this year and it's gonna be on next year until it goes to a referendum. So I'm not gonna diminish the importance of this because we're we're saying move ahead and it's not a disrespect to anybody that's here. [1:35:09, 1:35:17]: It's simply saying that this is a new agenda item, and the process have always been to deal with new business in the form that it comes in. [1:35:18, 1:35:35]: I I I wish that we wouldn't use words like we're disrespecting anybody. Everything on this agenda is a part is important. It may not be as important to the ones that are here as it is for the thousands that's been an annexed into the city, but everything we do is important. And it's not a disrespect. Mayor Ford. [1:35:35, 1:35:46]: Yeah. Well hold on, stand by a second, stand by. We could be through talking about this by now. Oh I'm sorry, sir. We could be finished talking about it instead of talking about it. Right. Okay, stand by, stand by. Yes, Mr. Mr [1:35:46, 1:35:48]: The disrespect is [1:35:49, 1:35:51]: To leapfrog [1:35:51, 1:35:54]: An agenda item says new business eighteen. [1:35:55, 1:35:57]: To leapfrog over [1:35:58, 1:35:59]: The public hearing. [1:36:00, 1:36:15]: Which was scheduled and we voted on earlier today to deal with it. That's that's my only concern. I'm not saying not entertain agenda item eighteen, but to leapfrog agenda item eighteen over. [1:36:17, 1:36:25]: The public hearing. That that that is my criticism of this process. All right. All right. So well, okay. So if we got two individuals, stand by Mr. Walt. [1:36:25, 1:36:37]: Two individuals say they want to rescind it. Okay, so otherwise what I understand from the attorney, we would have to do another motion, uh if I understand this right, to re instead reconsider this once again. Is that correct, sir? [1:36:41, 1:36:52]: Okay. So I need a motion to reconsider whether or not we are we would what's over this one has to be res reset do we have to do a motion to resend this all initially or just to just to say a motion to reconsider? [1:36:55, 1:37:05]: from the table then the chair will do a motion that we consider or if there are going to be enough votes to where the members would want to ascend their votes and they can do that and then [1:37:07, 1:37:19]: Okay, how about a motion to reconsider it uh whether or not we've taken item number eighteen and move it up and talk about it right now or not? Is there is there a motion to if I can do this is this proper motion is there a motion to do that now? Mayor forward. [1:37:19, 1:37:20]: I move. [1:37:21, 1:37:22]: That [1:37:22, 1:37:25]: Agenda item eighteen. [1:37:25, 1:37:26]: remain [1:37:27, 1:37:41]: in its current location for discussion. Okay, Mr. Blount, second that. As long as we talk about it. Okay, second. From Mr. Thomas to Mr. Blount. All right, all in favor of that motion. [1:37:41, 1:37:46]: Is I'm sorry. I'll put it looking at its current location. [1:37:46, 1:37:49]: Back to the current location, which is linear number eighteen, which is at the very end. [1:37:50, 1:37:55]: The motion was to move the to to take item number put no item number eighteen back to eighteen and not do it now. [1:37:57, 1:37:58]: Does that understand that correct? [1:37:59, 1:38:00]: That is correct. Okay. [1:38:00, 1:38:06]: So on f do you you clear on that, sir? Yes. Okay. All in favor, please indicate. [1:38:06, 1:38:18]: Oh announced decision. Is that announced decision? Okay. Sorry, Miss Wall, you gotta wait, sir. All right. Now on that note we do have a public hearing. All right. Now public hearing and so let me go through this. [1:38:19, 1:38:35]: Right now. Public hearing rules. Please mute all cell phones and electronic vices. If anyone wishes to speak tonight on a public hearing item, please fill out the form available on the table and hand it to the uh city clerk before approaching the podium. After each case is called, the council will hear from the city staff. Certainly there's a policy of ten four and ten against. Right, there is. There is. There it is. But we've we've adjusted you know we as a council, we have adjusted those. I understand that the policy is ten four and ten against. That's correct. So what what process are we following? Are we following the procedure which is the first one? Yeah, we're gonna follow that. [1:40:39, 1:40:46]: We'll follow that procedure initially and then if it comes to the point we need more time, I'm going to ask you all whether or not you want to grant more time or not. Thank you. All right. [1:40:47, 1:41:06]: All right, public hearing 2024 DAD to 2028 of the City of Starbury Short Term Work Program and Capital Improvement Element. Council consideration of the adoption of the twenty twenty-four to twenty twenty-eight city starbury short-term work program and capital improvement element, STWP slash CIE, presented by Mr. Ryan, please sir. [1:41:07, 1:41:10]: Okay, this is our presentation on our [1:41:10, 1:41:30]: 2024 to 2028 short-term work program and capital improvement projects. Most of the projects come from the community development department and the public works department and also economic development. We have several different categories. We have several projects on the community facilities, totaling 29% [1:41:30, 1:41:34]: nine million one hundred and seventy nine thousand nine hundred dollars. [1:41:36, 1:41:39]: We have uh several projects on the economic development. [1:41:40, 1:41:42]: Toting two hundred and twenty thousand. [1:41:43, 1:41:49]: And we have several um projects under land use totaling one point five million dollars. [1:41:51, 1:41:58]: And also there are projects on the transportation totaling fifteen million six hundred and twenty-five thousand dollars. [1:42:00, 1:42:15]: And uh hit this page right here is the update on our short-term work program uh from last year and programs in the past. And you can see that these projects have been completed. There are 13 completed projects totaling forty-five million dollars, well over 45 million dollars. [1:42:19, 1:42:27]: And on this page is our capital expenditures project summary. Most of these projects right here stem from public works and parks and rec. [1:42:29, 1:42:45]: They're totaling um eleven million dollars. And the funding type um mostly come from Splosh and Future Splosh. And um some of it even come from the general, a portion of it even come from the general fund and um CIP bonds. [1:42:53, 1:43:13]: So this is our public facility type, um, our wastewater programs. And we we had um collected five hundred and eight eight thousand five hundred and eight thousand dollars in impact fees from um, I mean from our impact fee fund balance carries over from the past year for five hundred and eight thousand. Uh last year we collected [1:43:13, 1:43:16]: [6197.4, 6202.6]: And our total impact fee fund balance is six hundred and thirty six thousand eight hundred and eighty seven dollars. [1:43:23, 1:43:23]: Um [1:43:24, 1:43:26]: Now we're ready for our public comments. [1:43:27, 1:43:29]: First of all before public comments though, first is that [1:43:30, 1:43:32]: Council, you have any questions for Mr. Anderson here? [1:43:34, 1:43:54]: Go go write it, please. Certainly I think folks should understand that what we're doing, the projects like the amphitheater, the improvements, downtown traffic, all of that is a part of our our plan. It's not just happenstance that we work on these things. And certainly I think what I heard a lot of is uh some concern is what some [1:43:54, 1:44:14]: Or what are y'all doing for the youth? What are you doing for the youth? I heard that so many times and I certainly want to ensure the public that we're doing that and that is a part of our plan. And one of the things that we're talking about is the Senior and Youth Recreation Center that has been on the council's list for us to move forward with uh to do something. [1:44:14, 1:44:25]: with so certainly I just want to assure the public that we certainly intend on providing youth activities and at the center of that would be uh the recreation center. [1:44:27, 1:44:29]: Any comments from the council? [1:44:29, 1:44:37]: Certainly I want them to be able to indicate or to show that on the program. This one that should be on one of the capital projects on there. [1:44:38, 1:44:39]: Mm-hmm. [1:44:39, 1:44:44]: Okay, if the Northern Congress of the Council now opened it, and the community facilities [1:44:44, 1:45:04]: Right, from community facilities. And certainly I think the public should understand that we went and we visited with Congressman Scott uh at at National League of Cities uh with a and uh we talked about a sum of eighteen million dollars that uh he would try to secure for us in the federal budget to be able to uh [1:45:04, 1:45:24]: Actually move forward with this facility because it's going to take a great deal of funding. And while all of you all are sitting there, SPLOS 6 is coming up next year. The facility that we had designed by TSW will be about$30 million. The facility includes an indoor pool. [1:45:24, 1:45:44]: Includes a walking track, a cafeteria. It is reminiscent of Welcome All Park. So if we're able to sustain that$18 million in funding, federal funding, then the council here will have to put the rest of the remainder on splotch number six, and you all will get to vote. You vote if you vote yes. [1:45:44, 1:46:04]: Then that additional funding that we need to build the recreation facility will be approved. If you vote no, then the recreational facility will not. Many of y'all ask, well, where you know where do what do you all get to participate in the process? So if we're able to land that$18 million in funding for the Youth and Senior Center, then you will be given the opportunity to [1:46:04, 1:46:21]: to pro to approve the rest of the funding as we've heard out in the public about the Youth and Senior Recreation Center. So we seri we're serious about moving forward with this project and I certainly will be advocating for that additional funding to be included in splotch number six. [1:46:24, 1:46:26]: All right, any comments from the council? [1:46:27, 1:46:30]: If not, then open up for a public uh public hearing. So [1:46:31, 1:46:41]: If they're I'll start on my my left. My left. Anybody over here any comments uh for or approve uh this particular um um short term work program? [1:46:42, 1:46:43]: Four [1:46:43, 1:46:46]: In the middle. Anyone wanna speak for this? [1:46:48, 1:46:55]: My far right. Anybody want to speak for? Okay, back over here. Anybody want to speak against this process on the my far left? Anybody want to speak at all? [1:46:56, 1:46:57]: Anybody in the middle? [1:46:58, 1:47:05]: Anybody on the right side, my right side. All right, so on that note, this piece of this part of this uh public hearing is closed on this particular item. [1:47:06, 1:47:13]: And so if that is the case, then council I need a motion to I second. From Alexander to uh Gantt. All favor please indicate. [1:47:14, 1:47:34]: All right. And uh okay, we've got four. Mr. Uh Thomas was now present. Okay. Uh next we'll continue on with the zoning modification case uh ZM 2023-01. This is uh council district five, council consideration and request for a zoning modification. [1:47:34, 1:47:37]: [6457.6, 6477.6]: To allow for multifamily residential development in pod A and to allow senior family residential in pod B, identified by parcel number zero five three-01018000. The property has a is 14.634, excuse me, 14.63. [1:47:57, 1:48:17]: Acres and is assessed via Chin Parkway and Argento Drive, landlots 77, 78, and 83 of District 6. Application by Michelle Y Swane, member of applicant of Southern Consulting Services Incorporated, which is owner. Staff recommendations are [1:48:17, 1:48:37]: approved and the planning commission recommendation is approval. Applicant uh requested a deferral to the November course, November 13th, 2023 council meeting, which is the night. And says presented by, well, Mr. Ryan, I guess you have it. And thank you, sir. Yes, sir. Okay. This is um is simply um a request from the owners of the uh bridges adjournment. [1:48:37, 1:48:40]: [6520.4, 6527.4]: revised their conceptual site plan. Their plan was never meant to be a permanent site plan. It all it was always meant to be fluid. [1:48:47, 1:48:59]: So basically they're coming in to m to move some development around from one pod to another and also to change um a residential use, single family residential use to a multifamily in um pod A. [1:49:00, 1:49:08]: Here's the site from area photo before it was developed. Here's the zoning map of the area. [1:49:13, 1:49:23]: Here's the location of the proposed multifamily uh residential development. It'll be called Thompson Thrift. Here's the uh original Bridge of the Jodico site plan. [1:49:28, 1:49:48]: Here's another rendition of the uh concept plan. And uh these are the parts. The uh site plan has been divided into uh like seven or eight different parts, numbered A through G. And the activity will take place in part A. Uh, here's the new site plan that was issued. [1:49:48, 1:50:08]: Um last month, well, two months ago. One thing about this plan, it does not increase the density, it does not increase the number of units. It all stays within the approved DRI approval back in three years ago. So everything's basically says the [1:50:08, 1:50:28]: stays the same. While um there is a need for increased density out at the um Bridges of Jodico site so that they can attract um more high-end um developments, high-end restaurants and things of that nature. Um staff feels like this is a good idea to um and also [1:50:28, 1:50:48]: Also because the market changes, staff feels like this is a good idea to uh allow them to replace the um the the single family detached residential with multifamily and also to the to build uh senior housing out on the site. Uh the applicant is here um to answer any additional questions, but this is just a simple um [1:50:48, 1:50:57]: Revamping of the conceptual site plan. Like I mentioned earlier, the plan was never meant to be permanent. It always was expected to change. It was always meant to be fluid. [1:50:58, 1:51:18]: Sir. All right. Thank you, Mr. Ryan. Okay. Mr. Alexander, go ahead, please. So certainly as District Five uh representative, so what you're saying is that the zoning board has voted for approval. Yes and the staff recommendation is approval. And um this fits in is in keeping with where we're trying to go with a quality mixture. [1:51:18, 1:51:38]: use development uh and at the Jodico project and actually uh what it probably would do is it will offer us some additional opportunities to be able to control some control the use at that particular pod and for us to be able to and the applicant will be making a [1:51:38, 1:51:49]: presentation on their particular uh on their particular um pod with renderings and what have you of the uh of the proposed change, correct? [1:51:49, 1:52:09]: Yes, sir. They will. Mm-hmm. Okay. Thank you. All right. Any other qu yes, sir. Quick, please. Yeah, when this project initially came to us, we had different elements in this project. And over time that even this council that was here at the time when it first came, we initially came, we saw that modif modifications were needed for this project. [1:52:09, 1:52:29]: project in order because you want not only attract businesses but you want to attract the uh the you know you want to attract everybody. You talked about the uh senior piece and you talk about the the piece where the uh uh mixed use piece where you're gonna have the younger people who wanna come and you know you know stay we we're trying to keep people in the [1:52:29, 1:52:40]: city of Stockbridge area. And so that that helps to generate that. So uh I'm for this modification and however we need to move forward with it. All right. Thank you. [1:52:40, 1:52:41]: Yeah, questions for the council. [1:52:44, 1:52:52]: Did the advocate need to say anything at all? Jeff, you want to. Okay. [1:52:56, 1:52:57]: Thank you, Mr. Allison. [1:52:58, 1:53:18]: Mr. Grant, welcome once again, sir. Welcome, Mr. Mayor. Thank you so much, Mr. Mayor and the City Council. And and actually you're you're exactly correct. We're not asking for anything other than just a modification to shift the different proponents around on the site that has been deemed more appropriate for the uses. We're not asking for any more density, we're not asking for anything any more than what we're doing. [1:53:18, 1:53:27]: was already approved. It's just shifting around the sites. We we think it better fits what we're trying to do. It gives a better quality. It fits better. [1:53:27, 1:53:30]: Uh and I think it actually flows better. And so um [1:53:31, 1:53:36]: with this th the the importance of a project this of this size and in substance [1:53:37, 1:53:57]: It's always good to have a council that that works with you because when I come to you guys and you understand what we're trying to do, you come out on site and that's the best thing we can do. You guys have been great to work with. And and I tell you, I think everybody's gonna be proud when we get through with it. And um also for anybody that's here that uh Costco's will be opening this Thursday. [1:53:57, 1:54:17]: Thursday, Thursday morning. So we'll have a groundbreaking this Thursday morning. So hopefully everybody can come. But that's basically it, um, uh Mr. Mayor. That's and I certainly appreciate it. No problem. Sir Stand by Mr. Grant. Got questions for you? Yes. Go ahead, Mr. Alzheimer. Thank you for coming out tonight, Mr. Grant. [1:54:17, 1:54:37]: Appreciate our ongoing dialogue about what's been going on and and the project is just turning out to be phenomenal. Thank you. And I want to thank you for your patience because as you we've discussed many a time, you could have filled up that development five times over. Oh, yeah. But you turned down many options that we just we wanted to make it a a [1:54:37, 1:54:57]: area of distinction. You wanted to make it a area where it was just it was different. It wasn't what we already had. And uh that it was uh it would it the my desire and as I spoken to you was to be an area of distinction, that it would be our area uh where folks would go to for entertainment, that they would go to [1:54:57, 1:55:17]: uh to enjoy themselves and they would be very walkable. We got all of those components in this particular development that we wanted. You may you talk to the uh zoning advisory board about the the upcoming tenants and I think many of the people in this room may not may or may not know uh w who uh who all is coming. [1:55:17, 1:55:37]: So maybe it would be great if you could tell the audience here, give that same presentation about some of the tenants that are coming that you've confirmed up. Yes, I'd be more than proud to. On the commercial side, of course, we've got the uh uh you've got your new Chick-fil-A. Now this is a it's gonna be the first one actually in the country that there [1:55:37, 1:55:46]: it it's the first and they're gonna have the first prototype that's coming in. Uh of course you got your Starbucks, your Chipotle, you'll have the first Whataburger we'll have here in the Countywood coming in. [1:55:47, 1:56:07]: Um we got uh a salad to go on the restaurant sides we're gonna have uh the ones we've got committed right now are are first watch. Uh if you've never been to a first watch, it's more of a breakfast brunch type uh restaurant. Uh Bahama Breeze uh is coming in. Uh we look to have the uh uh uh [1:56:07, 1:56:22]: probably our our project Inc. with Carabas here very shortly. They've shown a very strong interest. We're wanting to fit them in on the upper corner. Um we've got several other restaurants coming that we're talking to right now. We've got um [1:56:22, 1:56:42]: Uh probably the the one that we're gonna be that we're hoping is gonna be kind of our prized possession here is gonna be it's it's more of a condo hotel. It's um uh it one of my clients build these worldwide. They're they're it's basically the first, it'll be the first multi-story building you'll see probably on the south side. Yeah, his his are basically two. [1:56:42, 1:56:56]: 12 stories. The bottom four floors are your hotel. The um fifth through the tenth floor are fee simple condos. And everybody for the longest time has always said, well, Henry County's not ready for something of this substance or this style because it's too expensive. [1:56:57, 1:56:58]: Well, I'm I'm here to tell you. [1:56:59, 1:57:19]: That out of the 60 condo units we're gonna have, the starting price for the two-bedroom condos are$750. The end units start at a million dollars. They go up, the three bedrooms go up$50,000 per floor. The two bedrooms go up$25,000 per floor. Now from the fifth floor up, you can see Stone Mountain. From the sixth floor up, [1:57:19, 1:57:37]: you can actually see the skyline of Atlanta. From the seventh floor up, you can actually see Truist Park. So to give you an idea of how well these are sold out, our client that plans on building this, he's already pre-sold the first 30. Of those 60 are pre-sold. [1:57:37, 1:57:44]: He's allowing us to sell the 30 that we want off. Of those 30, 16 of those are so. There's only 14 left to sell. [1:57:45, 1:57:57]: they ha the price average on those will probably average over a million dollars apiece when we get through. So for people to say that the South Side doesn't attract the the um [1:57:58, 1:58:18]: The restaurants and what have you that that this just not here. That's just not the case anymore. The South Side has come back alive. The people here really are wanting this. And what we're finding out by being patient, we're getting restaurants here that we've never had before. And so we've got a couple of restaurant sites that we're holding. On top of this, there will be a rooftop bar and a rooftop restaurant. [1:58:18, 1:58:38]: It's gonna be a name brand steakhouse that you will recognize that you more see in Atlanta that that has agreed to come. And then once we get that done, I can announce that. But you've got a couple other restaurants I think that will be very unique that you see in Atlanta that you normally don't see on the south side anywhere. [1:58:38, 1:58:57]: yet that we are and have been very very patient and and you are correct, Mr. Alexander. We could have sold the Jodeco out two and three times over, but we we there were and don't get me wrong, the vendors that came to us that we've turned out are very good vendors, very strong vendors, but it's ones we always have seen. [1:58:57, 1:59:17]: And so we're trying to track something that that's a little bit different than what we've seen before. And so um we're proud of it. I I I think by being the patients and having the uh efforts with you guys working with us hand in hand, this is what it takes. And so uh this is something that you know most people don't realize. I've lived here in this county all my life. [1:59:17, 1:59:37]: Life. Matter of fact, my my grandmother's house, we live right here where the city City Hall exists, is where I lived all my life. And so my wife and I moved out to Lake O'Coney. My office is still here in McDonald's, so I'm here every day. But being here, my family has been in this county since the government gave land grants. [1:59:37, 1:59:43]: indeed signed is by sight signed by John Quincy Adams. That's all of my family's been here in this county. [1:59:43, 2:00:03]: Now, people say, well, you're developing this thing, you're making money. Well, I would hope we we do make something on it, but we've put a lot of time and effort and years into it. But it's not just that. We we own in this county about 4,000 acres. And I'm here to tell you that out of the 4,000 acres that we own, we have set aside almost 2,000. [2:00:03, 2:00:21]: thousand acres they had previous zonings that everybody in this room would have hated. They would have brought more traffic. They were bad designs. They were, they were, the density that they gave were just unbelievable. All those tracks have been set aside in perpetuity, will never be developed. [2:00:21, 2:00:29]: And these tracts are gonna be we we have posted them with the Southern Conservation Trust and other trusts, but we're gonna be opening these up to the public. [2:00:29, 2:00:33]: And so this is two thousand acres scattered around this county. [2:00:34, 2:00:38]: That probably eliminated eleven thousand houses from being built. [2:00:40, 2:00:49]: Then I and I'm just wanna tell you so when you see me standing up here, there's a little bit more pride in just this project. I wanna see this county do well. I've raised here all my life and I love this county. [2:00:50, 2:01:10]: Thank you thank you sir. Well I appreciate that because I met you down at Chris Tucker's golf tournament absolut with em with uh Emmanuel Lewis. Webster, you guys have bought conservation land all over the place. That's where I met you at. So certainly and then I think we talked about Sprouts Argent on the farmers market. I'm sorry, that's one of the main ones. I don't know anything, but yeah, Sprouts is also coming in. [2:01:10, 2:01:25]: And we're actually with their y'all just got them permitted. I think we're gonna be breaking ground on sprouts. Probably in the next thirty days, we'll be breaking ground with sprouts. They are coming in. All right. Well I thank you. I appreciate that. Thanks. Thanks, sir. Thank you, Ms. Grant. Appreciate that. Yes, sir. [2:01:26, 2:01:46]: It's gonna be wonderful living in Stockbridge. I'm gonna live in my same home though. I'm not moving. Yeah, sidebar joke here, I guess. All right. All right. All right. So I'll start on my very left. Any uh comments uh for necessary uh in reference to uh this particular zoning. [2:01:46, 2:01:48]: Uh [2:01:49, 2:01:50]: Anything in the middle? [2:01:51, 2:01:52]: In my far right. [2:01:53, 2:01:54]: Four. Okay, anything against. [2:01:55, 2:01:56]: Once again my far left. [2:01:58, 2:01:58]: In the middle. [2:01:59, 2:02:19]: All right. Seeing none, I'll close this particular hearing. Council need a motion to accept this zoning modification. Mayor, I'll make a motion for for approval as the applicant has requested. Okay. I second. Okay, from Alexander Miss Gann. All in favor, please indicate. Okay, unanimously. Thank you very much, Council. Okay. [2:02:19, 2:02:35]: Comprehensive Plan Amendment KCP 2020 2023-02 Council District 4. Council consideration of a request for a comprehensive plan amendment to assign the future land use designation of high density res uh residential. [2:02:35, 2:02:55]: to property at fifty five Ballyhill Road to allow for construction of a town home development. The applicant is D.R. Horton Incorporated, represented by Tiffany Hogan. The property represents parcel number S 16-01006000, located in land lot sixty-nine of District 12, and it contains [2:02:55, 2:02:58]: four point nine six acres within the Stockbridge City limits. [2:02:58, 2:03:11]: Staff recommendation is approval and a planning commission recommendation is denial. Application applicant requested a deferral to the November thirteenth, which is tonight, twenty twenty three. Council meet once again, Mr. Anderson, please. [2:03:11, 2:03:30]: Good evening. Good evening. Um the the parcels the parcel in the property in question consists of twenty four point nine six acres. Currently the the property is is developed with two warehouse build buildings. The current land use designation is light industrial, meaning um a warehouse can go there right now. [2:03:33, 2:03:45]: Here's uh aerial photo of the of the property. The subject property is right here and um there is a recent development underway right here, the Diamante Townhomes. [2:03:48, 2:03:55]: Here's another uh photo of the property. You got an office right there, you got a warehouse right there, and you have an existing shed on the property. [2:03:58, 2:04:10]: From a site visit staff took pictures and this is the existing site right now. Got a lot of the lap I mean old wood and logs on the site. They got a old office building and a old warehouse. [2:04:11, 2:04:15]: Uh the current um [2:04:15, 2:04:29]: Future land use map designate the property as light industrial. However, the future land use map is incompatible with the requested zoning MFR, and that is the reason what triggered the need for a comprehensive plan amendment. [2:04:31, 2:04:33]: Future land use map right here. [2:04:35, 2:04:47]: You can see that the industrial um site is kind of uh not in is is is kind of becoming um outdated because there's not much um light industrial in the area. [2:04:48, 2:04:59]: Right now, the changing conditions of the community. Here's the zoning map. You got light industrial right here and light industrial right there. But most of the other properties or surrounding properties are residential. [2:05:01, 2:05:21]: Um to the north of the property you got um vacant land. It's low density residential and low vertical mixed use residential. To the south you got single family residential, and you have Clark Park and Gardner Park, and the land use is medium density residential and park recreation conservation. To the east of the property, you got the Clark Park, you got public shopping center. [2:05:21, 2:05:23]: Yeah. [2:05:23, 2:05:43]: And um the land use is park and recreation conservation and low density vertical mixed use and low density residential. And to the west of the property, you got the big oak villas, the woodland ridge, and the north stock bridge development. And you have high density residential, medium density residential, and medium density residential. [2:05:45, 2:05:58]: Here's uh a map with all the surrounding land use densities. I don't know if you can if you can see that good, but it lists all the surrounding densities. And the property is compatible with the surrounding land use. [2:05:59, 2:06:06]: As a result, staff recommends approval of the project due to the compatibility with the surrounding community. [2:06:09, 2:06:29]: Here's a copy of the um of the site plan, but we'll discuss that in addition. I mean in more detail during the rezoning case, but here's a a s uh a site, I mean uh a picture of the site plan. However, there there's been some last-minute changes uh that the applicant will explain when she comes up. Um [2:06:29, 2:06:42]: The number of proposed units has been drastically reduced and uh some other changes have been made to this site plan. And we just got that in today around four o'clock, and we didn't have a chance to incorporate that into our staff report. [2:06:43, 2:06:50]: So once again, the the proposal is consistent with the comprehensive plan and staff recommends approved. And the applicant is here. [2:06:52, 2:07:08]: All right, thank you, Mr. Anderson. Okay. Mr. Blount, you had a question already? You said that uh th the site uh without the whether we do this amendment or not is already. Run all night, a day, and J Brakes run with the night. [2:07:09, 2:07:29]: So I chose to put the winding subdivision there and wine creek town home. So it's not in isolation what you're trying to do. But what you need to understand is these situations are real. It just happened. Just happened in that 500,000 square foot warehouse is under construction right now. And this property right now, it's wild. And if the zoning is not changed to a residential use or some other use, it will only [2:07:29, 2:07:49]: Anytime we get an opportunity, this is on, we can't just arbitrarily change somebody because we did lose the value of their property. What we have to do is when a developer comes forward to us, and that developer says to us, uh, we will change, we would like to change the arms to residential. And they did so literally, because that wouldn't be the property. When they changed the designation, they authorized us to change the designation to a design. [2:07:49, 2:08:09]: I'm saying to you right now, I would have done anything if it would have been given us the option to say, we'll take it over this 500,000 square foot warehouse, all of these trucks went in and I do co road. We didn't have the option. You do. Listen to the presentation, listen, final decision I've made. But that's something that I did not know coming in here, understanding what's gonna happen, a particular situation was [2:08:09, 2:08:29]: Now secondarily to this, we do understand that uh the uh way forty two widening has that by G Dot and that the the contractor has the right to start with widened the way forty two from the Walmart under Lark to four lanes or for Walmart two at I sixty five. It will also add a ten foot multipath. [2:08:28, 2:08:48]: Down that entire sector. We add additional traffic improvements along this sector as well. So that should be taken into note. And certainly this is a perfect opportunity, as I mentioned to you earlier, that y'all take into consideration. Splosh 6 is coming up. And T-Splos number 2 is coming up. So as you guys seem very organized and you very well out and you want to be heard. [2:08:48, 2:09:08]: should do and all of us just to make sure that we have a transportation project for Valley Hill Road on fly six and on T splash number two. Make sure that these uh projects are moving forward. As a matter of fact, guns have already begun with Commissioner Neat Robinson about what we can do because she lives right down the street in Pine Grove in order to get these improvements done. This area is living with [2:09:08, 2:09:20]: just answer into the city. It's amazing how we hear from various presidents on flipping road along various areas in the city that we want these roads right now. Well you know when the can when you when those roads were in Caleb Valley Hill and Flippin' Road. [2:09:20, 2:09:40]: County should have widened your own, should have paid three. They did not do that. They have a two hundred million dollar budget here. Our budget is about twenty six million dollars. Ninety percent of funding for tax money goes to the county. But in it's like you got a lot of credit requests from residents saying, We need to fix that road now, we need to fix that road now. But for thirty years or whatever, we're till getting time. [2:09:40, 2:09:44]: road was already in the county, those improvements should have been made. [2:09:44, 2:09:58]: Other considerations that you have to understand when you vote who did not put any money into these roads. Why didn't why why somebody put some money in Valley Hill Road when it's accounting for all of those years? Why wasn't it paid? Why is it in the content that it is in right now? Why? [2:09:58, 2:10:18]: Understanding that you as a citizen have to elect people that are going to vote to put your interest to make sure that those those are to make sure the improvements are done. Understanding that you should not understand the decisions that they weigh heavy on us. Because the last thing that we want to see is 500 square foot rap warehouse right down the street from you. And you complain about the traffic. [2:10:18, 2:10:23]: But man trucks coming too late will be a disaster for you. Thank you. [2:10:24, 2:10:37]: Um I wanna council exercise on that and I just want everyone to think uh uh particularly uh from our viewers on a lot of issues. As of today, if someone came here and said and they wouldn't come here, they don't have to, they have a right right now to doorhouse. [2:10:38, 2:10:39]: Right now. [2:10:40, 2:10:47]: And we could argue stuff in the warehouse. We don't want this. We don't want this trust. There's nothing we can do because it's right now zone. [2:10:47, 2:10:49]: Right in street. [2:10:49, 2:10:55]: Right now. So understand they don't come in here to ask us permission to build that word because it's already [2:10:55, 2:10:57]: We can fight it, but we're g soon we'll lose. [2:10:58, 2:11:07]: So do we it's very rare that we get opportunity to prove that must develop something that's not a commercial or credential piece. Very rare and when we get it. [2:11:07, 2:11:10]: Let's do grab it and take a hold of that opportunity. [2:11:10, 2:11:14]: Because that prevents us from having a light industrial. We can't change it otherwise. [2:11:15, 2:11:35]: So just want you to kinda think that um all the times we get those questions. We you know, someone will say, You m you and the art complex here, you did we don't we didn't do anything. We don't have a right to change it a specific time to do so. So just you guys and that. Thanks for me. Yeah, comments from the council. Real quick um if you don't see a warehouse that g because a lot of these developers it's owned. [2:11:35, 2:11:55]: They see opportunity. They're gonna build even when someone's about to go into warehouses. If you go out on the if you go out uh boulevards 42, there's a warehouse on the right. It's unoccupied because these little these develop these people building these warehouses and now they're looking for occupants. And I take your head, sir. [2:11:55, 2:12:00]: So I'm gonna come in and get pop, go to Wales, and then wait my own com and then there's nothing the council can do. [2:12:00, 2:12:02]: Ms. Bobway, please. [2:12:03, 2:12:06]: Thank you, sir. Um this is City Council District for the district. [2:12:07, 2:12:07]: I did. [2:12:07, 2:12:25]: an opportunity to address. I do want to still have the presentation presentation presented by the developer so that those owners live in close proximity have an opportunity to see it. I have conducted two community outhauls to discuss this very proposal. The reason being is this is what my councilmates decided. [2:12:25, 2:12:29]: The profit is already zoned for light industrial. I'm concerned about a wheelfinger. [2:12:30, 2:12:32]: Prudential would probably be the best option. [2:12:32, 2:12:37]: I support high density, but nice, I'd like to move forward so that a presentation can be presented. [2:12:37, 2:12:39]: And we can hear from home. [2:12:40, 2:12:45]: And to share some of the concerns um that came of community from that I did. [2:12:46, 2:12:48]: Is that it'd be in the record? [2:12:48, 2:12:56]: Mr. Thomas, you're only when I spoke. Anything you need to say, sir? No. No problem. Okay, uh Ms. Tiffany, here. Wanna come forward, ma'am? [2:13:03, 2:13:06]: Good evening, Mary. How does someone double protect up? True. [2:13:33, 2:13:53]: Good evening, Mayor and Council. My name is Tiffany Hogan. I'm the Vice President for Planning for DR Port Nana Easton. I have with me this evening also Mr. Smith, who is a traffic engineer technical and actually prepared the traffic study at Traffic Count and at the traffic impact study for that. We were nervous regarding the traffic, so I did want to come here this evening. I will quickly remind my presentation so that at least some time clay as well. [2:13:55, 2:14:15]: This evening we do have the replica that we filed, a comprehensive plan amendment says current is light industrial, uh, and we are proposing that with high density residential. Then we also uh will have a rezoning application because it is currently light industrial, and we are seeking to rezone multifamily residential and develop our homes. And then we finally have a variance your code required. [2:14:15, 2:14:22]: A 50 foot back, we are seeking a variance to 25 feet for that. Uh we will deal with the comprehensive land plan first. [2:14:22, 2:14:40]: Here's the site again. Staff pointed that out in a great way to you just looked off of Atlanta Road. One of the things that we're really excited about this project in Philadelphia, uh planned for a beautiful presentation because it is located right off Atlanta Road, which is becoming one of the main entries to your city. So we want to have a project there that everyone can be proud of as they're traveling uh get to your new theater. [2:14:41, 2:14:41]: Mm. [2:14:41, 2:15:01]: Fifty five value uh is twenty four point nine acres as staff as stated. We are seeking now we have reduced count to one hundred and fifty six town units on the site, which is just over six units per acre. One of the things to make out of our request uh for high density residential for the prehensive plan is that your high density and your code actually starts just uh threes per acre. That's actually below [2:15:01, 2:15:13]: steel to be considered IC residential. So as everyone is considering that, I just want to make sure keeping in mind uh their code is a little bit lower than other jurisdictions in the metro area. And six years per acre is actually per low for town home development. [2:15:15, 2:15:21]: And here the full stater. There are two points located here. I just want to point those out now. Uh [2:15:22, 2:15:42]: The Valley Hill Road to Home Development Comprehensive Plan, Community Goals and Policy. It provides to make sure to attract young professionals, singles, and small families, maintains a family-family environment of protecting and retaining young people. It creates a sense of peace for community along our commercial corridors, and it identifies opportunities to create new trail connections between the existing parts, central areas, and the downtown. [2:15:42, 2:16:02]: Welling to point out those connections, we will be putting ten foot sidewalks on the exterior of the property. There will be eight foot sidewalks internal on both sides of the street for connectivity throughout. One of those changes that staff mentioned to you was there actually used to be a cul deck at that top part of the site north side up by Valley Hill. We have now connected that. Some times that we received at the community hearing. [2:16:02, 2:16:17]: and Barber mentioned early feedback we received in the community actually limited that back, made it a full loop instead for continuity of vehicle traffic as well as pedestrian traffic with those two units. That also gave us the opportunity to add an space in that top area and so additional parking spaces. [2:16:20, 2:16:40]: And again, here is the subject property. The light industrial the blue has just been surrounded by other residential residential pieces now as time. You do have because McSanna across the street there, uh of course is a non-residential use, but pretty much everything else in the area is a residential use. Under the current mid light industrial uses, by right, these are some of the things that would be allowed. Of course, the biggest is the whole system. [2:16:40, 2:16:44]: Many of these do also include warehouse tight. [2:16:45, 2:17:00]: And I will stop my presentation there not just focused on comprehensive land plan. Uh and then it'll be further details during the summer presentation. And available available for any buttons that the council members may have clay of the boys. Yeah, that's what I was gonna ask them. So but questions that council may have this point. Sorry? [2:17:01, 2:17:04]: I have w what um I have one if I may mean. [2:17:05, 2:17:07]: So you originally had how many units on the property? [2:17:08, 2:17:17]: The very early plan actually called for almost two hundred units. Almost two hundred. We reduced it this week reduction. And what was your uh recent thing? Uh we the first time um for [2:17:18, 2:17:38]: Once we realized high density was such a low, we need to get closer uh to that six units per acre, uh that's the first reduction. The second reduction was a design in order to add some additional parking space. And the third reduction just happened over the past week as feedback from community. So when we removed the um stack, we added some additional parking and we wanted to reduce the units a little bit with her closer to one fifty. [2:17:40, 2:17:50]: Yeah, um Barber we have a question. Actually there were several uh concerns the owners had. Um I appreciate you meeting this as well. [2:17:50, 2:17:51]: Um [2:17:51, 2:17:58]: I know that you just int that your original plan came with two hundred units. That's close to I can't remember the count now. I believe that is a bit [2:17:58, 2:18:05]: In fact, um lower the density to under 150. I believe you got to a hundred and six. Um [2:18:06, 2:18:09]: We still need more than a hundred and fifty. Even with you removing um or [2:18:11, 2:18:16]: Removing the what do you call it? Cold process and connecting it. It just looks like you reconfigured some of the [2:18:17, 2:18:17]: [8298.3, 8301.3]: And you didn't remove or reduce the amount of units. [2:18:22, 2:18:42]: So some units were actually just open space editor and that can happen. And one of the things that we consider with getting 150 units, your code actually requires a clubhouse for more than 150 units. It's not required for than 150 units. So if we go that, we're not required to the clubhouse. Additionally, because we all have mandatory HOA in this community, we want to make sure that the prices remain attentive for support these. [2:18:42, 2:18:50]: Fees and one of those iterations is will HOA fees be in the future? So if you need to reduce the number of units, that increases the HOA fees for the rest of the units that remain. [2:18:51, 2:18:53]: Thank you for that explanation. Um [2:18:53, 2:18:56]: So is this the proton to discuss that through [2:18:57, 2:19:00]: The access road that can from Valley Hill Road, Davis Road. [2:19:01, 2:19:15]: So it is a actual road entity and not really an access road. It's meant for it to be a part of the community. Um, I think that I can go further details with the reasons I used to make your adaptation and the concerns that came up from the community. Okay, because that is gonna turn to access. [2:19:15, 2:19:18]: This pulse development is right next to the rural tracks. People are gonna [2:19:18, 2:19:20]: Um as a throw. But nonetheless. [2:19:20, 2:19:22]: I will wait. I'll hold just mine. [2:19:22, 2:19:24]: Points and sorry from the residents. [2:19:25, 2:19:45]: Yeah, so thanks so much. I appreciate that. I understand, you know, in the end it has to be profitable and it has to be worthwhile in order to do the time you got some number down it affects profitability and then the overall H certainly want to community to be maintained. Is this gated community? It is not a gated community. Uh we find that when you sometimes gate the town community. [2:19:45, 2:20:05]: community that sends a number message um that you're trying to keep folks uh in other than um make it a free flowing community. We want to promote walkability to two parks that are close by to this. We want to promote walkability to the amphitheater. The amphitheater is one mile from the northernmost point. So those folks that are in the back will actually be even closer than I'll and [2:20:04, 2:20:24]: be able to walk there as well. That's one of the great things about this site is the amenities that already exist from the backyard dollars, the folks that live here have the ability to get to easily. Well l let me just say this you ask me, I like to see a gate. I like to see gated communities, especially in the multifamily um developments. It send sends out a great message which is secure here and that it protects community. [2:20:24, 2:20:44]: And suddenly um I understand that at 150 might be where you need to be at a serious that included a gate and it could be being gated to keep it 156, certainly we'll do that because I think the community does need to be gated. I think that's what we be consistent in resonating that I do. The down right across right on the lateral is gated. Right there before it's send. [2:20:44, 2:21:04]: and out of messy consistent with and has the same uh small use pass obviously the residents exit through eight to access the multiple use pass along each other and then along frontage. So certainly that my that would be my preferred thing. I'm not sure what the what Ms. Barber has to say about that, but certainly uh that's consistent with what we did. David Road had eight too, so that's consistent with what we've been doing. [2:21:05, 2:21:25]: Okay. Any any track questions, answering track questions on the area. Well, I tell you what, how about give information you just showed us? So we contracted we were contracted to look back in the area. We thought that might be um so that was of discussion at this meeting. So looking at the traffic generated, okay, we do a lot of traffic impact studies for [2:21:24, 2:21:44]: variety of elements that mixed use development we were just talking about with those for anything like we've talked about before different types of uh full use of that roadway base road and uh like hill road um residential use is commercial so when we're looking at residential development the number of trips that are generated residential development is significantly less compared to a mixed use element has commercial or commercial hours so the number of trips are going to be lower in that scenario [2:21:44, 2:22:04]: Scenario compared to an industrial, it's gonna be very certain down two minutes per square footage of the industrial development, how many employees are gonna be at the industrial development. Um when we ran through so looking at forward, we used a very conservative growth rate for historical growth rate in this theory because we were seeing some growth over a period of time. So what we calculated and we actually use, we use something that's higher than we actually calculated slightly just a little bit of conservative. [2:22:04, 2:22:17]: buffer there. Um well second the analysis, uh what I'm gonna point out is have different access points allows the vehicle do an out of byte to access both access points, which disperses the traffic, which can the act the traffic has to any one point within your existing roadway network. [2:22:18, 2:22:38]: We also looked at operation of the traffic signal, East Atlanta Road and Valley Hill Road. In existing conditions, conditions with background growth accounted for in community, everything operated adequately. It's level of service C or better. D is the lower threshold. So it's actually operating better than adequate. Uh we put the project trips again by the time we disperse the trips. [2:22:38, 2:22:45]: out we were showing the majority of our trips getting to East Atlanta Road because that's the road that has the highest volume today can still operate a quickly. Um [2:22:45, 2:23:05]: We even if you start looking at the intercept and going approach by approach, it operates adequately with project um built. So uh we looked at uh preemption preemption uh occurring with trend come through that range between between ten and twenty depending on day. They did seem to avoid the P and P fit that's the surge of traffic, so that's that's a benefit. Um they even set out their monitored traffic for PP. [2:23:05, 2:23:17]: period in the afternoon. And we were able to well road, it does seem to clear most most of the time in one cycle based traffic signal time parameters. Um can be adjusted based on growth we recommend do every two years just on the growth in the area. [2:23:17, 2:23:18]: Sure. [2:23:18, 2:23:27]: Okay, another question council I'll open up this portion of the uh of the uh public for uh open my vlog any uh comments for comments for approved for this particular development. [2:23:28, 2:23:29]: In middle and comments for. [2:23:30, 2:23:32]: A far right cover four. [2:23:33, 2:23:37]: You're in the middle. You're in the middle. [2:23:38, 2:23:58]: Positive comment. Okay. On the right hand side. Positive comments. Okay. Negative comments comment that you not you get this in the far left hand side. Far left side. Okay, in the middle. The negative comments comments you're not four. If you line up one side, uh might be stand up first, line up to the mic. Any negative customer lineup right of first you can. [2:23:57, 2:24:08]: Okay. All right. Just line up. All right. Now. [2:24:08, 2:24:26]: And regular in a rule in twenty ten minutes. Now we make we have made adjustments based on what the council wants to hear. All right. And so when it comes for your name and your and start comment uh we'll monitor all this with the time frame. And we'll see how that how the flow goes with that. All right. These these are these all the people speak this stickler vote. A lamp on this side. All right. [2:24:26, 2:24:27]: Mm-hmm. [2:24:28, 2:24:37]: Madam Stop, good time. Thank you. Thank you, Mayor. Mike Davis, please. Uh my name is Mike Davis. I'm representing Red Sean Restaurant at three eighty East Dime Redstone Bridge. Okay. We've been there over twenty years. Um [2:24:39, 2:24:49]: My uh infrastructure track at uh intersection. Um I know Mr. Clay did a wonderful job of uh representing uh what he thought was uh good all that. Um [2:24:50, 2:25:10]: I've already seen where at our front it's hard to get in and out already and the units that are just uh north of us have not completed, which is over two hundred units. So once once those get the traffic from the residents there, which is gated community, which is awesome, but um it's congest there. Um and it'll uh I'm afraid it can uh is much of it should be [2:25:10, 2:25:19]: Before all these has to come in and uh and all the business coming right there, uh I'm concerned about being at the restaurant. Uh I respect the ask y'all to consider. I know that um [2:25:19, 2:25:23]: Uh it's right now. Um [2:25:23, 2:25:43]: Again, uh they consider maybe uh residential, just a single family residential instead of multi-family uh as a zoning. Um and some brought up the walkability to the parts. Well there's a railroad track where it separates those uh unit from our units. Uh so I don't I'd say that'd be a safety issue for people walking from this new five vehicle route that cross-sun railroads. [2:25:43, 2:26:03]: to get Cock Park or to walk on down to the theater. And then lastly, uh on Please Africa Impact Study, um, where it signs are at the amphitheater, I know East is down and things happen there. And I believe it adds a whole lot of extra stress coming down East Atlanta Road up to through Valley Road as well. That's my concern. Thank you. Thank you. Appreciate it. Go ahead, name and address please. [2:26:06, 2:26:22]: I'm Stephen Bradford. I live at Two Orbits for sixty four years. Uh I mostly my concerns are basically what Mike's got, you know. Uh cheap road is horrible when a train comes. You live in that gate and you won't get out away. Wow. [2:26:23, 2:26:24]: And they just [2:26:25, 2:26:25]: Uh [2:26:26, 2:26:27]: You know, I don't understand. [2:26:27, 2:26:29]: Thank you. [2:26:30, 2:26:32]: Am I allowed to ask a question? [2:26:32, 2:26:40]: Well come in. You got a lot of time. Uh you put a question you need to ask, you're gonna ask and we'll see if we can get back up later to that question, but go ahead. [2:26:40, 2:26:44]: I'm really concerned about that people and close to the railroad and they're good there. [2:26:44, 2:26:46]: And our children don't want to go to the park. [2:26:47, 2:26:48]: But they're road tracking blame. [2:26:49, 2:26:49]: You know. [2:26:50, 2:26:51]: It's that jury's waste. [2:26:52, 2:27:09]: Uh and I just don't I don't see where the the planning for that many people with jewel at Clover rail track includes not being able to thank you. Thank you. Yeah, sir we'll railroad track we'll talk we'll address that. No, so the clerk of Clara. [2:27:10, 2:27:23]: My name is Joyce Andrews, I have it tool and up north Star, Tibetan. Been there thirty-three years in Big Oulus. And I'm not real happy about I've been here in so many kind of complex. [2:27:23, 2:27:27]: Object of obvious and especially well they hear load. [2:27:27, 2:27:32]: If you've ever been there, it is traffic GMR radio on Valley Hill Road because the rail crossing. [2:27:32, 2:27:37]: And it's not their design to have that anything. So I'm I'm against this. [2:27:38, 2:27:43]: Not in favor at all. Okay. Thank you for your commitment. Next lady, please commit address. [2:27:47, 2:27:50]: Say going to Tian Oaks, North Stoppers, Georgia. [2:27:50, 2:27:51]: Uh. [2:27:51, 2:28:11]: due to transformation. Uh got enough on Valley Hill certainly and on this road. I believe that most of the people coming from the youth vision will be exiting Davis. It's all impossible at times now to turn on thirty two from this road. So this will make even worse. Uh schools I believe will be able to handle additional students that will have um [2:28:12, 2:28:13]: Nobody's [2:28:13, 2:28:19]: Um also I'm concerned about removal of all the trees by the railroad tracks. You can hear the trains. [2:28:20, 2:28:29]: A lot. I mean we can hear this building. I can hear it in a house off of Davis road. Once they remove the though they're gonna be putting these buildings up, I don't believe it's gonna be sufficient. [2:28:29, 2:28:33]: No, I oppose. Okay, thank you. Sir, any minute, please. [2:28:35, 2:28:51]: Thanks for hearing hearing me. My name is John Reith. I live at 150 Days Road. Um, while I agree with Rogers and I agree that we don't want industrial park there, I am concerned about the volume of what we're putting in the area infrastructure that we have currently. I invited I see a constant [2:28:52, 2:29:12]: flow of people walking down the street, no sidewalks. Sidewalk start 42 A.N. Once you get past the trailer park section, there's no sidewalk on that part of the road. So I'm not sure how people are gonna come down Davis Road to go even to the or to even go to the amphitheater. We're talking about Easter Land. You go over you past public sidewalk ins before you get now what's [2:29:11, 2:29:25]: developed or not, this sidewinds there's you're gonna have to cross over a busy highway on what little sidewalk there is there. Um rains, it floods streets because the uh pipelines and the district aqua already there, you're gonna clear property there and you're gonna cause more runoff and rain the area. [2:29:26, 2:29:28]: Well thank you, sir. Appreciate it. [2:29:29, 2:29:33]: Uh yeah. Two. Come on. Sir, please. Thank you. [2:29:34, 2:29:35]: Mm-hmm. Name and address, please. [2:29:35, 2:29:55]: Thank you, Councilman. Church Bear and decided that one set over call north. And uh I hope that the council does consider the saturation that's already taking place in this area. And I know it's belongs to someone and they have a right to do something with but yeah. The Disney is is uh number one. Well let me go with the traffic. It's uh it was described better than the addictive. [2:29:55, 2:30:13]: On the yeah, I am thinking at an o'clock night it might be. But it's uh usually it is not. Uh but they so we have cons and the track is difficult and this won't be compounded. Okay. Also, you know, reducing the number of um uh reduce uh the number of uh units from [2:30:14, 2:30:34]: Then reduced the decrease. Seems like you know, reducing it to double is not much of a but you know, if this is I had I realized that this was a zone flight industrial and um as [2:30:34, 2:30:37]: [9038.3, 9058.3]: Um keeping in line industrial than rezoning it to multi family. We have the density and the um the develop throughout this area and we w are is already exceeding capacity. You see in a whole lot of of open space uh semi um. That's to hit him in a bit, but I would imagine also we'll give a few lymph you know [2:30:58, 2:31:18]: Okay. I'll be as brief as I can. So but yeah, the station of development we already have, and there's an awful lot of in space. I'm not inclined to think that uh could be very, very wrong. Uh a developer would be inclined to make put another giant warehouse, you know, uh but would that be more desirable? [2:31:18, 2:31:31]: more than 150 residents uh uh uh added to this area when we're already choked from a traffic standpoint. I don't know how the infrastructure handle uh the current air infrastructure that we handle what um what we add but it just [2:31:31, 2:31:51]: uh you know we're saturated. And and I hope that the the council does consideration to that that like, you know, there's not that many trees or groups of trees that's that hasn't had something done with it this area. And we can solve this and and I'm very much against adding it a hundred at home to this area. Appreciate it very much [2:31:51, 2:32:11]: Okay. Mr. Gardner and the gentleman that was called the transportation, could you back to putting place? I forgot the else could you cut to vote for carefully. Um part of the uh I would say one thing that I want to mention passing that deals with the trade itself and the zone. Mr. Gardner, come on please. Uh the five zone that we need to be finalized and that involves safety or safety procedures in this aspect as well for three costs, both north and south and middle. [2:32:11, 2:32:26]: down down. And I believe our T Splash when we talk about these will be part of the process to to send past to make it a little more able to trans transfer a walk a bike and the total design area to try to connect everything but be helpful for this well. Assuming I was thinking about anyway, um on that note, um [2:32:27, 2:32:32]: Sir, c any other things that you need to emphasize in referring to transportation starting to come to reemphasize your point. Yeah, so don't go with Gardner. [2:32:33, 2:32:39]: So we were looking in our diligence. So nice would also design an operational actively managing signal. So [2:32:39, 2:32:42]: [9162.6, 9182.6]: The old traffic design were installed. So one thing that we notice is during preacher, it doesn't look like there's any type of tension on the west side of the train track. Also, pre routines have changed because we changed traffic signal software about four or five years ago. So we have more flexibility on what we call correction of of split allocation. That's just how much time is getting to movement. We have capabilities now. It's just your phone, you update your phone, you have more technology in your phone now. [2:33:02, 2:33:22]: You'll allocate that time in a more efficient manner. So that's changed. We know that it hasn't changed since the old cigars plan in the past, the new software. So we have access to that data. Um, we talked about some of these splash lands, you know, been in multiple splash lands, not updates to the newer software. So one thing that we've talked about was it could be efficiency gained by adding that detection on the west side of the tracks so it doesn't call a gap out, turn knock people out. [2:33:22, 2:33:42]: out. Um we looked at intersection and the um traffic counts that we performed counts in August this year. So this is an old counts, these are new and schools. So we did an author sometimes I'm sure you don't get them in a lot of what everything was clearing one cycle. Specifically the hill road, you know this is again less C, so this is adequate per and the user dot standard G dot standard as well service C or [2:33:42, 2:34:02]: Or better. So that's a correlation to how long vehicles are hanging. Even with the product trips, um we're not saying of a change to Q length. We're looking at one, two cars, any peak period of this. We're looking three years into the future. Again, we use conservative backgrounds, so kind of worst case scenario. The one thing I want to point out is the site layout, and I mean it's a natural, natural effect. If you look at it, we think the south. [2:34:02, 2:34:05]: sedm to the north and they're roughly equal in this layout. [2:34:05, 2:34:25]: What's what's great about that is we're distributing that traffic in a man we know that we're gonna go back to East Atlanta Road to hit because of the type of roadway it is and the amount of it carries. So the amount that we're actually adding to Al Hill Rough take carries about seven to eight thousand vehicles compared to Davis Road, which holds about fourteen hundred vehicles. We're only adding a twenty to thirty vehicle in a peak period to Valley Road. So the movements are not not drastic. When you start leather movements, [2:34:25, 2:34:45]: Um the less than one vehicle of queuing. It's an indicator of extreme label. We know that keeping people off the track is key. Everything looks good on analysis and in the field and pulling the um this for operational data as well as the design data for the industry. Mr. Thank you, sir. Anything at all? [2:34:45, 2:35:05]: No sir. Sir, I just want to double check with you. You good? Okay. I I click here itself. It's false. What goes with those kind of comments account? Yeah. One of the things I've always that we uh and I both told each uh district representative, I respect that they take the lead. So when we come to co meetings and we ask developers to make changes in their amendments, then it puts all [2:35:05, 2:35:25]: But in this case with this property here, I would say counselors when you deny uh the zoning, they can't come back for another year. And with that year, anything coming there for warehouses. So there's a compromise to be made with this developer. I would ask council to be able to make adjustments with the thing back with the compromise that's too to you because we [2:35:25, 2:35:45]: We don't make a decision today. This stuff's never one size fit all. It never is. But we do our best to make it more amenable to what is what you all want in your community. And and if we deny it, it's some of you all are saying, I don't want to be true down the road. It's saying, I like C development development, but I like to see this and see that. So maybe uh because I I heard that as mentioned um in this [2:35:45, 2:36:03]: You we don't ever want to put a developer in a position where now they're wanna then they gotta come back in a year. But I think the compromise for us to where they would compromise development. I think that we should I would motion table this and bring it back to the council uh and sit the developer to have a compromise then and then how you want to develop. [2:36:03, 2:36:23]: Okay. Mayor. I just know what you're saying, Tom. I also have some concerns because when I heard Mrs. Tinney speak, she spoke and I asked specifically drop down to hundred and fifty six from two hundred. They have uh it seems like and maybe she can come up and tell us how this has so far, see there's some type of negotiation back and forth and agreement. [2:36:23, 2:36:43]: Also another agenda item um which is move from two feet requirement to twenty-five feet. I'm thinking there's some give and take there. If if the if we don't move, what is that gonna cause a reduction of of homes? My concern is ensure that we get the peace property um [2:36:43, 2:36:57]: But coming up how many of you and no S is now add how many of you chapter just in the era has been happening there. Because if we don't do if we want to prove site, who's to say lambes or anything taking place? So I tomorrow's coming about land with house. [2:36:57, 2:37:00]: So now no make it sill and there's nothing we can do about it. [2:37:02, 2:37:04]: We're gonna make some negotiations, some changes. [2:37:04, 2:37:06]: Mm those changes [2:37:06, 2:37:13]: Ain't gonna be done tonight. Unless you haven't had that opportunity to negotiate. And Miss Tinny, if you don't mind if you can get that for me, I appreciate it. [2:37:16, 2:37:36]: Councilman, we have we held a voluntary community meet, write our phone allocation, and then at the request of the councilman, two additional um town hall meetings where we discussed it as well. And we did stuff items that we did negotiate the first time. The gate request come uh there was a request for some speech bombs because Councilwoman Barr mentioned she believes that we will become an access for the top. [2:37:36, 2:37:56]: entire development. So I think in order to achieve uh slowing traffic um instead of speaking and protection of the community, we will be willing to perfect I'm trying to mold too much. Um since the committee of Annister do want to give the council of information that you make a decision based on um for plan application. Um but if I think a gate would help to to [2:37:56, 2:38:16]: Two of the requests have come some additional security fill as well as slowing uh the possibility that coming uh through road. Um but otherwise, there are several things you'd like for me to go to the list now of the things that we did just negotiate? Okay. Sure. So um one of the things that Wesreaks did [2:38:16, 2:38:36]: was in the area at the top in the original plan. It was cul-de-sac there. Uh there was a question about being able to loot that for continuity. So we did make that change to that through that process. And because we knew it was a request to get closer to 150 units, we did reduce some units. In fact, the original design that came back here today still had over a hundred [2:38:36, 2:38:56]: Mixed units, even with Lean Dunn, specifically called the engineer back and asked him to remove additional units to add some open space and get us into one piece. Um as well. Um we also had a question about buffers. So uh along the railroad track side, the buffer um of the entire site is required to be 25 feet. [2:38:56, 2:38:58]: So [2:38:58, 2:39:18]: to the back property line closest it I'm sorry to the buffer line is one hundred feet then you have twenty five foot and then you have a twenty foot rear set back for each one of the yards so that's forty five feet and then one hundred feet at um first point to the road track. So we did not add an additional buffer there because that's pretty simple you have a hundred and [2:39:18, 2:39:38]: There was a question about putting a fits there. We are have a plan to leave that buffer unserved at additional land gap because again that is along East Atlanta Road. So it would be pretty heavily planted along. We did not think that a fence would be the most aesthetic look or the comment that came as well. [2:39:38, 2:39:41]: [9586.2, 9587.0]: Yeah, cheese a little bit. [2:39:48, 2:39:49]: Yeah, that's what she's in. [2:39:53, 2:40:13]: For she's looking for all concerned questions that I too. But now mm-hmm. So there was a question about the clubhouse. Um the obsidian square foot and we provide an emission over uh total over two thousand foot feet for the clubhouse. Uh we were asked for the track impact study by the track engineer that the recommendations were very [2:40:13, 2:40:33]: Minimal. Uh, I did felt point out earlier there are these links on both the entrances that's one of the commands there just to pull out traffic as they're turning into community. Uh there was a request with the variance setback uh that requested to make it 35 feet instead of 25 feet. We are respectfully requesting that it's a variance to 25 feet. Uh a townhome development in the county would require a 25 foot setback. [2:40:33, 2:40:53]: And most of the jurisdictions are 25 feet. Your zoning that allows for town home development is a multifamily zoning. And so that is a 50-foot environment there. Uh is that multifamily developments and that town development consistent with town industry centered home development and those jurisdictions around you is a 25-foot front sec. We also are aware of the precedent that was set recently for another development. [2:40:53, 2:40:56]: Town home development also has a twenty five foot front sack. [2:40:56, 2:41:15]: Uh we were installed a maximum total percentage to include that in HOA governing documents and have that five percent and step percent, we've agreed to five percental cap. We were about having um the monument along Valley Hill Road to connect to the park upon the um regulation. We determined it was not a at least with our evaluation that we could within a week that connection. So we did not do that. [2:41:16, 2:41:31]: Uh discuss the pump and the cul-de-sac. Uh edible landscaping. So one of the things that we were asked to do is include edible landscaping. I saw your browse kind of so edible lab is like berry trees or apple trees or something like that. Planting is a hardwood that some of the trees in development would be edible landscaping instead. [2:41:33, 2:41:53]: And ask to relocate some of the guest parking to center development. Uh so I know this is kind of far off from you guys, but there is parking that is right at we were able to addition parking on the northwest side there. There is guest parking at the amenity there. There is guest parking straight down that main road valley hill entrance. There's guest parking on the left side over there as well. And then there's [2:41:53, 2:42:06]: There's also a guest parking lot on Davis Road and some additional guest parking spaces on the outside of that. So guest parking is throughout the project. And we were able to add additional spaces around that amenity area bell. So we have a total now of uh four guest spaces. [2:42:07, 2:42:20]: Thank you. And uh Mayor comment is part of this uh nothing with you, but uh actually for me in regards to your comments, so thank you. It sounds like there have been some negotiation that have taken place. Um my I her comment that [2:42:21, 2:42:38]: We can change it, change it to single family. And that's something I want to discuss. That's the exact what we said earlier, some councilman eleGantt. We could have a developer here who has fought an application to reduce drop down from light industrial to a a a a multi resident. [2:42:38, 2:42:41]: If someone came in if someone w purchased too simply [2:42:42, 2:42:48]: And we would had opportunity for that tonight, but that's not what's being. We can't do that. We can only [2:42:48, 2:42:53]: vote on what has been applied for. If we don't vote tonight, [2:42:53, 2:42:58]: And it's and it's and it's uh label and it's remains the same, the light industrial. [2:42:58, 2:43:01]: That's what we're trying to say. We can't wish I could. [2:43:01, 2:43:04]: I wish I I wish I could, but we [2:43:04, 2:43:06]: I don't we don't have that right too though. [2:43:06, 2:43:07]: And so [2:43:08, 2:43:08]: Yeah. [2:43:09, 2:43:12]: With that comes trucks, comes all kinds of things. [2:43:13, 2:43:30]: And it didn't do. So I'm what I'm saying to you is we can't I wish we always hear it all the time. I'm not in the neighborhood. We want an apartment complex. We don't want towns. We don't want we hear it all the time. But there's a a difference can and cannot do and if we were like this today, tomorrow someone could be building a warehouse on it. [2:43:31, 2:43:32]: That's all we're saying. [2:43:32, 2:43:33]: [9813.7, 9821.3]: Thank you. Um actually uh the idea or suggestion was made during the community farm um requesting that homes built instead. [2:43:41, 2:43:43]: of high density multifamily. [2:43:43, 2:43:44]: Development. [2:43:44, 2:43:48]: That's one of the questions that I submitted to you because you already answered during the forum. [2:43:49, 2:43:59]: Certainly something that I would sort, but however I cannot sort Mr. Um there was no negotiations. In fact, what I sent were concerns and additional uh conditions to consider. [2:44:00, 2:44:06]: Those were sent Miss Hogan to be I expected to receive answers from those concerns and conditions. [2:44:06, 2:44:09]: Proxy today. I didn't get response until [2:44:09, 2:44:10]: Today. [2:44:10, 2:44:13]: I want to be able to review them and of course negotiate. [2:44:13, 2:44:18]: However, uh based on what I'm hearing now, it sounds like my councilmates are already making a decision. [2:44:18, 2:44:20]: For my district, once again. [2:44:20, 2:44:20]: So [2:44:20, 2:44:36]: What I have said just based on the concerns that were expressed by the presidents who attended the two community forums I hosted, um, of which I thank you, Ms. Hogan, for taking the time to meet with us and share your proposal. Um, one of the concerns, of course, appearance thirty five feet. [2:44:36, 2:44:40]: This one was the Mac Rental percentage. I know that in our code um there is [2:44:40, 2:44:42]: Um ten percent rental. [2:44:42, 2:44:42]: Um [2:44:42, 2:44:44]: Yes, that you reduced at five percent. [2:44:45, 2:44:48]: The third one was the Corn Monument along Valley Road to Nextwood Park. [2:44:49, 2:44:49]: Um [2:44:49, 2:45:09]: And I don't know what your responses were. I got them today. Um decrease the density in a hundred units. You just explained that it wouldn't be feasible to all. Um install speed bumps or posts to slow down the vehicular inside of the development, because that is gonna turn into through road. I can see that now. The railroad crossings. Um [2:45:09, 2:45:10]: [9911.2, 9911.7]: Um [2:45:12, 2:45:18]: I uh removing the cul de sacs. I thought there were three or four or buildings that were there. Um [2:45:18, 2:45:21]: I see that you removed those buildings. [2:45:21, 2:45:25]: And the call back into connect the two roads, but it looks like it's at those units. [2:45:25, 2:45:34]: Somewhere within the development so it didn't decrease the amount of units. Um asked to remove move those six units closest to the rail tracks. [2:45:35, 2:45:38]: The one all the way to the right looks like it's [2:45:38, 2:45:39]: Six. [2:45:39, 2:45:41]: Um those weren't for me it looks like. [2:45:42, 2:45:42]: Is that correct? [2:45:44, 2:45:53]: Additionally mentioned during uh the community forum about the edible landscaping. That's a great idea and the homeowners want to keep that. Um to install a fence along [2:45:54, 2:46:00]: Um decide where the rail crossing is, in addition to the uh cheese as a buffer. It's for safety. [2:46:00, 2:46:01]: Measures. [2:46:01, 2:46:05]: Also to increase the buffer to hundred feet along the road tracks. [2:46:06, 2:46:13]: I ask that you get so that it's not on the end of units. I ask that it be in the center for the development so that yes when they come. [2:46:13, 2:46:14]: Then I have to walk one end. [2:46:15, 2:46:16]: Uh, that wel. [2:46:16, 2:46:17]: The other is um [2:46:17, 2:46:18]: Whoever's on visiting. [2:46:19, 2:46:19]: Um [2:46:19, 2:46:22]: You add additional pardon. Uh well let [2:46:22, 2:46:23]: I want it. See and [2:46:24, 2:46:27]: Well one scene was being center throughout the development a short [2:46:28, 2:46:44]: Um certainly any off street parking and us with five feet at back, that's certainly what it's gonna do. There will be on parking, especially when there's a distance for guest parking. They're on far end of the building. But my house mates, um, since they're gonna support you also you don't need my support. But I want the homeowners to know I did the best that I could. [2:46:44, 2:46:47]: I brought plenty to our community forum. [2:46:47, 2:47:07]: I wanted to hear from you all. The community form was a way for the developer to come in to share their proposals. And I do have concerns with current zoning in industrial. That's the reason why I decided to hold a second community form so they all would understand the current as it currently is. Um but I did the best that I could. I'm hoping that my council will consider [2:47:07, 2:47:08]: Yeah. [2:47:08, 2:47:10]: Continuing to go development. [2:47:11, 2:47:14]: That area of Valley Road and Navy Road has um [2:47:14, 2:47:16]: Red interposes this year. [2:47:17, 2:47:23]: It is under consideration rolling infrastructure improvement plan with funds allocated. I can't support you. [2:47:23, 2:47:30]: Any development because how to put a road and infrastructure plan that includes Road and Davis Road. [2:47:30, 2:47:41]: That's the bulk of Maastricht. So please. So what was before actually a comprehensive plan amendment, okay? [2:47:42, 2:47:47]: [10067.9, 10087.9]: That that warehouse would be. You understand. You you you understand because you don't understand the reason that they chose location for the warehouse is because next railroad tracks. Those are called inland puts where the train stops and unloads their cargo at the warehouse. They yes, certainly. Yes sir. Yes sir. They chose that location over your car next to the warehouse. I'm just I'm uh [2:48:07, 2:48:08]: Yeah. [2:48:09, 2:48:29]: They have a shit of all the tractor trailers coming to your community. But see what's the reaction for you? And they need to speak anymore. Okay, this is about complex. This is about complex. That's right. Okay. [2:48:29, 2:48:49]: out for the structure of ten home delivery. That's what we do to vote on out. And if that approved, move on to the next step. All right. So you're a motion to accept this comprehensive amendment. Yes ma'am earlier Councilman Blount made a motion to table. There was a but no second I didn't make a motion. I suggest that we do it but when we talk about the number of units, uh you talk of three meters that put the community and the [2:48:49, 2:49:03]: and if you drop below uh 150 units, you can't put up a house suggested for the property. So you know, just like I've told everybody, it's no one size fit all project, any project that comes in. I'm not motioning I suggest it that way. [2:49:03, 2:49:12]: Do it. It was second this motion was seconded. Excuse me? I'm I'll make a motion to make a motion to approve. Okay there's a commission. [2:49:13, 2:49:19]: I have a second. Okay, this uh miss uh uh gas second motion. All favor, please. All posed. You oppose. [2:49:20, 2:49:40]: Three, one, you hold to sustain, is barber. Okay, so three two pass. Now we'll move on to the next one. Okay, three two motion passes. Result zero two three two four. Multiple family reservoir zone district to property by back here to allow for construction of a agent is the representative Tiffany Hogan. Property representative. [2:49:40, 2:49:58]: Number S 16-0100600K at land lot sixty nine of T 12 and tains twenty-four point acres within city starcy limits. Okay, and so Mr. Ryan is before us again. Uh okay, you press a deferral uh November 13th now some present nine, Mr. Ryan, please. [2:49:59, 2:50:06]: Okay, I'm gonna go all that. I and for the sake of time, I'm gonna cut my presentation short and just uh read the staff's uh now recommended approval with conditions. [2:50:10, 2:50:11]: Okay. [2:50:11, 2:50:18]: This is a rezoning talking about this number twelve rezoning. I'm number number ten. I'm sorry, I'm ten. Number ten, rezoning. [2:50:19, 2:50:22]: Well you can put it on here. It's not on here. [2:50:26, 2:50:39]: Uh right through the presentation. Okay, Mayor, I moved that we approve the re the um rezoning to assign the F Rony District to Property Five Valley Hill Road to allow construction of town development. [2:50:39, 2:50:56]: Motion is made in a second. You're right. Well, it is a diff it is a different it is a public case. That's right. That's what you got, Ms. Um okay, I'm sorry. Very good. That is right. And the question to the was to uh our attorney. If we're talking about the same piece of property. [2:50:57, 2:51:00]: We're talking about the same piece of property. Does each subject matter? [2:51:00, 2:51:02]: have to have a bookier discussion. [2:51:05, 2:51:08]: Because we're we already know what people are forgetting. We've heard already. [2:51:09, 2:51:18]: I'm not I mean again and I'm not trying to say that I listen don't buy these tough divisions, but you you make them so the question is when you pee you have a property up here. [2:51:18, 2:51:21]: Like this subject matter. [2:51:21, 2:51:28]: We do public comments. Everybody's talking about we no one was for it. We did against it. They've already spoken against it. [2:51:28, 2:51:29]: Would it [2:51:30, 2:51:34]: Do are we required to have a public hearing? [2:51:34, 2:51:54]: Council and clerk on to matter the norms. Never mind. Two people talking. My report would be yes. Let us refer to the I referred to. And although what is although it has been advertised that way in future I'm sure [2:51:54, 2:52:09]: For procedural purposes. When we talk about a particular piece of property and we have to go and vote on separate items for that property, or we are continuing to have public comments after each subject. [2:52:15, 2:52:28]: It doesn't have to say you don't have to decide this variance and this variance is separate if it's noticeable the variance of the associated property, then that can continue to develop you back. If you all time have your hearing you all just test, but one appearance and all the matter. [2:52:29, 2:52:30]: Yeah for [2:52:32, 2:52:35]: Okay. At one point they're having to do it individually over and over again. [2:52:37, 2:52:38]: I think [2:52:41, 2:52:48]: Okay. So basically the future when we talk about a particular piece of property wants public com they to comment. [2:52:48, 2:52:50]: That's what time we'll have to go through. [2:52:50, 2:52:54]: Who in the middle? Who's in a one time their opinions and discussing appointment? [2:52:55, 2:53:00]: That I just wanted to make sure because it seemed like we're we're done and we're definitely have to go over and over again. [2:53:01, 2:53:19]: Yes, ma'am. I just need patients. Because I can't mention that there was additional information that she would discuss when she got to be clear. Well, Ms. Holiday, let me clarify for you, as a real estate attorney, that what I'm trying to say is when we have a public hearing on any piece of property. [2:53:19, 2:53:36]: Yeah, when we have it, the mayor can announce and discuss each item prior to he can say we're gonna do this and this little piece of and so we have one public comment on against, not on and item eight, agitum item nine, because we're still talking about the same part. So it gives everyone an opportunity to speak that [2:53:37, 2:53:42]: That one we are gonna drag this thing out over and again. For the most part. [2:53:42, 2:53:52]: Everyone's gonna talk about the same thing, whether or not they were against this. Whether it's about the you put the request on on on how to be set back or whatever the case may be, it can be done in one setting. [2:53:52, 2:54:12]: Okay, got it. Ms. Hogan, you pass a couple of the mic, please. What I walked during your present initial presentation mentioned and you mentioned that you had some additional comments to make in your presentation when we get those different points on the agenda. Now some comments you may already made based on other information that came. So what I'd like you to do is I like you to go back to your presentation and go back to we're talking about zoning. [2:54:12, 2:54:20]: Highlight results highlight now, so we go through this process. And I say may it may take some time, so but we're gonna go through this process because what she initially indicated when she came up to the brief the first time. [2:54:21, 2:54:32]: So Mr. Bingy's statement idea covered most of it with questions I've asked. Uh particularly with going through the items that uh were requested as a result of the meeting. I'm sorry, I don't want to mess anything up here. [2:54:55, 2:55:01]: Do you need help with this? Uh someone needs to get to that pre back to your presentation. Yeah, they're coming up here. Do this now. [2:55:03, 2:55:08]: Okay. So I'm currently saying it's not letting me close it up any other way. [2:55:11, 2:55:13]: You can hit that'cause I don't have a version there, so that's fine. [2:55:14, 2:55:15]: Right. [2:55:16, 2:55:21]: Oh pardon screen. Got it. Thank you. [2:55:28, 2:55:32]: And I think someone would address the reasoning and area at the same time so that we can't move over. So I'll address everything. [2:55:39, 2:55:59]: Okay, uh so we are now looking at the rezoning and variant applic Oh, sorry. So we're looking at rezoning the variant applications to clear the light is currently light industrial and we are seeking a rezoning to multi-am residential as you've heard the evening. The thuks site is here with the star on it in the purple. So you have that little bit of light industrial there and then again everything else has turned to residential around here yet. [2:55:59, 2:55:59]: Yeah. [2:56:00, 2:56:20]: This is a lot typical of what the lot would look like. So we wanted to be sure to show this because we're required to reduce the variance to feet. So there has been some concern about the driveway length. Again, it is a par garage unit twenty-four feet wide. So people will have two parking spaces in their garage and then an additional two parking spaces in their driveway. Even with the twenty foot one of the concerns was that the possibility of it cost [2:56:19, 2:56:34]: If people pull their rocks the way that they should and don't pull so they're hanging off of their driveway, which whereas we can't uh determine whether folks would do that, uh there is enough space to car to be in a driveway without them hanging over the sidewalk. [2:56:35, 2:56:36]: This is what the site currently looks like. [2:56:37, 2:56:43]: These are the uh image of what the homes would potentially look like. This is a actual development right of the two four foot units. [2:56:44, 2:57:04]: The community that we seek to develop with provide a community field with amenities to one of the things in your comp plan they're looking for in the area is to rise into the development community fields. In the main amenity area you would have swimming pool as well as the cloud, a playground, uh a foot multi-use path throughout and ten foot sidewalks on fence as it said. And then everything that you saw on that side plane that was in the green is also uh [2:57:04, 2:57:24]: Common space. I'm going to that side for just a second to highlight something that because all of the lighter coloring space we have intentionally left provided that be developed. Darker green, there is a creek that runs the site. So darker green is the creek and the required local state and federal required. We will not be into those buffers of criticism requirement by law. We will get a creek crossing from the federal government or [2:57:24, 2:57:26]: [10647.1, 10659.4]: While I'm on the side slide uh slide, I would like to highlight once again the additional parking that is added. It is through outside. It is not the one area. Uh so there is parking almost on every street, on every block. Uh you could easily walk to the residence. [2:57:42, 2:58:02]: This is an image of the clubhouse. This is indicative of the community that this one was built in. This is the one that was built. Uh it's the exact floor plan of the clubhouse that we will build, but the facade will be made to match the units of this committee. This will hold that is built at another, but it will put it in here. It has the mushroom kids like the player as well. The clubhouse also has outdoor scene areas, building fans up there. [2:58:02, 2:58:22]: and outdoor for folks to sit and enjoy. Again, variance we are seeing is from a 50-foot front setback to a 12-foot front setback, which is standard in the three four developments now. We also know that recently there has been another approval without reaching from 55 foot. Uh and that if this project were built in the county, it would be 25 foot. That was part for townhomes as well. [2:58:24, 2:58:44]: This would be and actually this light at the count from the last week it'd be one hundred and fifty six moms now, four four foot wide, two car garages, one hour or less walk from the stockbridge amphitheater. It also connected sidewalks throughout the in the front of the property. All of the units are three bedroom units throughout. There is an option for one unit on the end of each building to be a four bedroom unit. That is option. It can only be one unit out of the [2:58:44, 2:58:45]: And toppling the orbit. [2:58:46, 2:58:49]: Uh we're exceeding a spark, your code requires fifth aspect, we're providing four percent spec. [2:58:50, 2:59:10]: And again, the MIDI theater that we talked about. One of the great things that we really love is the company was fitted on the principle of had a dream of homeownship to folks. That's to this day with the coming reality, it's really important to us that still growth. Opportunity to take homeowners as well. [2:59:10, 2:59:30]: Closing cost, which right now is$1,000. We also have a home buyers club because we want people to be successful in home ownership and not just be able to purchase a home. So our homeowners club actually educates folks on not only increasing their credit rating to get their rates, but also making sure that folks understand all of the uh expenses that come with homeownership so that they hopefully are able to maintain their homes. [2:59:30, 2:59:34]: This is available to anyone for the safe charge, even if you don't purchase a DR home. [2:59:35, 2:59:55]: And again, we've been American owners since 1978. Just earlier year we closed our one home in Texas. There's actual video on YouTube. Mr. Horton himself sent folks with their keys and sold the house to him at the price open in 1978. They did not know that was going to happen. Our agents are sell are trained to sell to owner occupants only and not to investors. So that's very important, of course, in a town home unity. [2:59:54, 3:00:08]: So you don't end up a community full of individual investors. We also do seminars at local agents on new home construction first time buyers. That's not our agents, that's other agents. They understand what to provide to those folks. And again, we talk about Main Street Stars Incentive program and the home buyers clip program. [3:00:10, 3:00:12]: And every of our home is smart home as a standard. [3:00:13, 3:00:17]: That concludes my presentation. If there are any questions, I am happy to entertain them and Clay is still here. So [3:00:17, 3:00:37]: Council. Minister Br president. I just want to say this, ma'am. I appreciate everything that you've done. I certainly apologize the way that you were treated and that you had negotiated with us in and you made presentations, you've compromised, heard the residents, and uh you were told that no matter what you did, that would not pay the the resident from that district for it. Sorry. [3:00:37, 3:00:57]: That's not the way that we should be making decisions with uh forethought with what we want to make sure that we take everything into co into uh uh account and that we do what's necessary to make the best decision possible. So certainly. Thank you. Thank you. All right. I'm gonna deal with briefly now. That's what I say. So I'll open up the public hearing. Listen it. [3:00:57, 3:00:59]: But if my far sightful [3:01:00, 3:01:00]: [10862.3, 10879.3]: Anybody in the middle four? Four. Four to four. Re zone issue. Anybody on the right side? Four. Okay, anybody on the left side? Against rezone issue. Anybody in the middle? Come on up, line up this side on this side. Alright? Against rezone issue. Line up over here. [3:01:19, 3:01:20]: All right. [3:01:20, 3:01:25]: Now it looks like we're not for give ten minutes please. So come to the podium, give me a name and address. [3:01:27, 3:01:38]: No name or you see it again. Name Stephen Brad on Let me upload Georgia. Okay. Rezone initiative. Go ahead, please. And I am concerned that we have people here that are for this. [3:01:38, 3:01:40]: They wanna put this in backyard. [3:01:41, 3:01:43]: Have y'all done research? [3:01:43, 3:01:45]: Do you know what limit for roads? [3:01:46, 3:01:47]: Baboo Dave. [3:01:48, 3:01:49]: Reason. [3:01:49, 3:01:55]: There is no address me by the way. Address me. There's a reason there is no activity in that building. [3:01:56, 3:02:09]: Pop company left, free company left. They were not allowed to go on belly food with babies who completely out of question. So I'm not worried about fair house being built. They can't tear books in and out. [3:02:10, 3:02:12]: That's a priestness video image. [3:02:16, 3:02:33]: My name is Eve Brad. I live at two three o'clock, no thought rich. I worked for a mid-state range. We did not have a lot of traffic that could m out of there. We had drugs with big pipes, but that's all that could come out there. There was no big trucks coming in, no big drugs going out. [3:02:34, 3:02:35]: There won't be concerned. [3:02:37, 3:02:39]: Thank you, appreciate it. Next individual and the address is. [3:02:42, 3:02:51]: Good evening, James Chale, one of the land of stock crits. Thank you for allowing me to speak to the board and the mayor. I've heard Ben say at times, I believe he's on staff, that uh the staff is recommending that this happen. [3:02:52, 3:03:04]: But I'm sure the Planning Commission is made up of very many competent individuals down there doing concerting the fifty Valley Hill Road Pride and have recommended denial. I stand with the Pennington Mission as well as many of my neighbors do. [3:03:05, 3:03:08]: Thank you. All right. No no need platform, sir. Your name and address please. [3:03:11, 3:03:21]: Thank you. [3:03:21, 3:03:22]: Okay, blue. [3:03:22, 3:03:42]: The topography of this area not really can too light industrial. I don't I think it's uh an empty threat. Because, you know, unless we're gonna lord the uh raised road, it's uh you know, getting track trailer trucks is will be uh onerous if not impossible at this page. Based on the weight limits of of all the access roads, the accessing that area with a tracker trailer is [3:03:42, 3:04:01]: I as as a person who operates tractors, it would be possible to to actually pull a tra trailer up there. I I mean unless part of the plan is to lower the railroads, I don't think. And nor is the an likely than erase the road. It's a particular anti threat, the light industrial the uh a lush warehouse could be better at this point. [3:04:01, 3:04:10]: Okay, thank you. Appreciate it. Thank you. Okay, no more comments. I'm no counseling motion to accept this reasonably. [3:04:10, 3:04:13]: Yes sir. [3:04:17, 3:04:23]: Is this the this the uh since this is going on so long? This is the rezoning with the requirements and the conditions of the [3:04:24, 3:04:29]: Yes, sir, but I need to repeat the um conditions into staff. Go right in. Go ahead. Okay. [3:04:30, 3:04:50]: Six conditions uh of approval. Uh first condition um rezoning is uh the rezoning should not be approved unless the applicants requested complaint amendments is is um is approved. Uh the rezoning should not be approved unless the variance is approved. Uh the proposed town belt shall constrain according to the design, which is similar to the one that's shown the applicant submitted site plan. Well, they had a revised site plan. [3:04:49, 3:05:09]: Plan was submitted today, so the date was changed to um November 13th, 2023. That's the one that's okay. Go ahead. Uh rezoning should not be approved once the unless the developer submits construction plan to Stockbridge Public Work Department June 29th, 2024. Otherwise determines their sufficient senator tool capacity to go to serve the whole building. [3:05:09, 3:05:28]: not be um unless the consumer traffic impact state which provide satisfactory traffic entertain data, which they did. The rezoning shall not be approved unless the applicant conducts an environmental impact which provides satisfactory environmental data. Those are suggestions. The applicant come back to the podium. That's good. Thank you. [3:05:30, 3:05:30]: Clear so. [3:05:31, 3:05:34]: We we had here we had the phone. [3:05:34, 3:05:48]: Your earlier. You can have one or look at all three of these issues. Yes, sir. When you vote going to singly vote on each issue, not all three of them at the same time. So one revenue, bezoning, etc. Variants, it'll be three votes. Okay. Okay. Ms. Hogan? [3:05:49, 3:06:08]: Okay, we we do we have the ten foot personality in the requirement here. I didn't hear the rip. That's part of the cycling. She's all right. Eight foot trails on the interior, ten foot on the exterior, and eight foot in the interior. Oh and it's position on that. But we also had a president set on Davis Road and on East Lana Road or gated community. [3:06:10, 3:06:10]: Shouldn't you [3:06:11, 3:06:17]: And I'm open to guess that b before. Um we do need to be cognizant of the cost that I will add, but I don't want [3:06:18, 3:06:32]: the gate to be something that will have us from move forward. I just think we want to be consistent with what we're doing. Everywhere we go, we net we had the same setback, we had the same requirements, Bon Stucco, certainly. Uh I wanna make a motion with this, the condition that consists be consistent with the other community with the gate. [3:06:34, 3:06:42]: So I'm not looking to the setback. We're not talking about setback yet. [3:06:43, 3:06:46]: So this this um you're good with that, you're gonna add in. All right. [3:06:47, 3:06:49]: Okay. [3:06:49, 3:07:09]: Um well I I don't know the the conditions I didn't see I had seen in years. Uh but I didn't know those conditions uh wasn't just long as the conditions everything understood what we're talking about pertaining to this. I just wanna make sure whatever we do on the night conditions are put in there. Sir could you make a motion please? So yes, yes, that's [3:07:09, 3:07:10]: [11232.6, 11244.4]: agreeable to five percent rental cap as well. Uh that was one of the things that was on the list. So she's asking should we call that second sh I'm that well add the five percent rental rental cap as well instead with agreeable [3:07:25, 3:07:45]: Is there a second? A second. Okay, any further discussion? None. All favorable please? Okay. UFA? So three zero three zero one. Right. Okay. Now, so we got got to should be total seven different uh eight lists. Eight. Okay. Okay. Yeah. Okay. I can learn how to count. All right, eight. All right. Uh so now what we have left uh also is the various case. [3:07:45, 3:08:05]: Coun council district four council consideration of the request of the various property fifty five Valley Hill Road to Left Town Home Furtherances allow the reduction front or setback from required fifty feet to twenty-five feet in MFR Mobile Family Residential Zoning District. The property represents parcel number sixteen-looking land line sixty nine of discount and it can [3:08:05, 3:08:25]: Text 24.96 start received is approval. Plain commission is denial. I'm gonna of course request a deferral to number 13, which is a nice uh meet. Mr. Ryan, please. Okay. I'm not gonna go through all the cyclines, just gonna get to the to recommendation. Staff recommended um approval with conditions. Um uh there are development hardships on property and [3:08:25, 3:08:39]: And uh we have two cases that we recently passed security that approve a twenty five foot um setback for our day go project and a three foot project uh foot front yard setback for two zoning events. We want to exist in zoning and staff remnant approval. [3:08:39, 3:08:49]: Okay. I'm trying to do that. Mr. Srian, I have a question. In regards to recommending the approval for fifty to twenty five [3:08:49, 3:09:04]: What's reasoning so? Um based like a pre like a little um there are developmental harsh property. Um some reason I was zoning um has a fifty foot standard with an industry standard town home, it was twenty-five feet. Um and [3:09:05, 3:09:15]: Another reason why we d if um it did not the uh variants we would neglect what we just did we were uh because we can uh the approval of the results and the complaint contingent upon the variants. So it wouldn't it would uh [3:09:15, 3:09:35]: Neg negate everything we just done. Oh, that's my made a few minutes ago. I was like, wait a minute, don't put the content of the variance within right? Yes. Okay. So I made that statement. In in addition to I could do thirty. Okay, I do thirty. But I I have concerns in regards to the setback. Okay. Right? Will it [3:09:36, 3:09:39]: Cause more [3:09:40, 3:09:56]: car all over the road. Well, um no, because in their site plan they added additional guest parking. They added a lot of guest parking. Uh sixty seven guest units. They would be centralized inside out. And uh their covenant will will not allow for uh on street parking. So it would be prohibited. [3:09:56, 3:10:09]: And like I said, if you um look at um all the other zoning ordinances within this within um most of 25 foot front yard set back requirement for our townhomes, there might be 54 apartments, but it's 25 industry standard for townhomes. [3:10:09, 3:10:26]: And I preach industry standards, but I'm stockbridge standards. And so my standards are gonna be just that. I mean, for goodness sake, agreeing to Eblin's captain. Right. So I have my own standards. Not and and those are the requirements to make sure that there was adequate parking lot. And I think that's okay. I would be okay with three. [3:10:26, 3:10:29]: Oh but uh Council Member's okay. [3:10:30, 3:10:33]: Come quick uh typing going back to Paul is. [3:10:35, 3:10:41]: So that becomes any question. If you you just give one minute, um I will see and you can answer. [3:10:45, 3:10:52]: And the reason that because engineering as I'm texting as Ryan said, topography in this, um and Ryan, do you have light plan here? Maybe helpful if we can show. [3:10:52, 3:10:53]: Yes, it's true, man. [3:10:54, 3:10:59]: Is still shows the same areas that I can point at oh okay. [3:11:04, 3:11:07]: Perfect. I'm gonna revert back to not though. [3:11:08, 3:11:28]: So this is actually the top survey of the site. So as you can see, there's just a nip drop as you go down the site. Um and also because it's actually cut soft. So this is the gray area is the area seen close to that creek. Really dark squiggly line is the creek. The way that the drop is, it will be um pretty difficult on a lot of these lots in order to have a um front yard setback that is. [3:11:28, 3:11:42]: Fifty feet for sure. Thirty feet, I tend to see it would make sense for the additional five feet because that site plan is based on a twenty five foot setback. So once you start moving that that ships the sidewalks, the units, everything go round. [3:11:43, 3:11:44]: Okay. [3:11:45, 3:11:56]: Based off of whether or not we fit a hundred and fifty homes within that the site plan. With our plane owning team. Our our department, our plane department. But I would I would prefer at least [3:11:56, 3:12:00]: Um understand your standards. [3:12:00, 3:12:11]: There's also things, reasons and and ways to think change. Whether we bid in roads are we now bid in our sidewalks to you know, to have these wide trail paths. So there's always room for change for me. I I'm room for but I'm also [3:12:12, 3:12:23]: Um hearing when the constituents when they are concerned we wanted at one fifty house units with fifty-six. I get it. [3:12:24, 3:12:25]: Yeah. [3:12:25, 3:12:26]: Having you know, snipbacks. [3:12:27, 3:12:30]: It was if we did it in the first place. So I'd I would [3:12:31, 3:12:32]: Uh maybe live early. [3:12:34, 3:12:54]: You gotta say you are reduced from two hundred to one fifty six, which means that you you redu that the two hundred was three five foot setway, right? Yes. So you reduce something thirty foot. I mean, I know you don't know the answer to that word per se, but I think if we made a motion and said uh basically we would ask for thirty feet, engineer allowed thirty feet that you would compile with that. [3:12:55, 3:13:04]: So what I would say is that it's not as simple math as you take those six units out to get the one. Don't say engine engineering showed that it was feasible to do thirty, you would do the third. [3:13:05, 3:13:20]: Yes, under how we make that a condition. And also to Ryan's point from earlier, their first tension with the rezoning is that the side plan. So I don't know if Okay. So that takes care of that. And I guess for the conditions if it's feasible with the engineer thirty? [3:13:21, 3:13:22]: Yeah. [3:13:23, 3:13:25]: If it's feasible, we could you'll have to do it. [3:13:27, 3:13:29]: Don't know how to address it at this point. We don't. [3:13:30, 3:13:31]: There were condition touches only. [3:13:31, 3:13:34]: Right. I mean the condition says if it's feasible that you would have [3:13:36, 3:13:46]: I can bring it to Ryan Future mics. Brian, if you can get to the make you want to speak. Just got an answer from the engineer. We can footstep there. Thank you. Thank you. All right. [3:13:46, 3:14:05]: Yeah, uh Ms What if we what's what size other roads what's what's the length I do a three foot other than a twenty five and it shortens the streets because I'm concerned about emergency units. What's size now? Is your standard uh when we did the pre application meeting the year was on there? Is your standard twenty six or twenty eight here? Twenty eight, it's twenty four twenty eight. Okay, got you. So we just make sure that's exactly what the three foot. [3:14:06, 3:14:10]: We will have to meet your requirements for your streets because well, I get now there won't be public streets because I get it. [3:14:14, 3:14:25]: The privacy now just going on railroad tricks. So they'll have to be a twenty sixty five fire cut. Yeah that's what they exactly twenty six feet. [3:14:26, 3:14:37]: Are you quickly for Okay, so again, we'll do this process for actual public carrying for the variance, for the variance. Anybody have left that's right, left side, for anybody in the middle for yes variants. [3:14:38, 3:14:40]: [11680.6, 11700.6]: Okay. Anybody against variants? Anybody against this variance on the left? Anybody in the middle? I'll speak against this. Come on. You stay on the recognition. But in the middle, uh wants to speak about the variance. I guess anybody on the right side. Okay. I'm not sir, you're up. [3:15:02, 3:15:11]: Yeah, it's a question. Okay. Then counsel Don Smith, Five One Townsend, Stockbridge, Georgia. Okay. My question is about the gate. [3:15:12, 3:15:12]: Gentlemen here about. [3:15:13, 3:15:14]: We'd be in the gate. [3:15:14, 3:15:30]: My question on gate is you said it's more inclusive, keeping everybody in the recipe. Okay. The genus is more exclusive. This is exclusive. Also, is it going to be a private street or public street? Because if I'm paying tax and you have a gate that tells me I can't go through there. [3:15:31, 3:15:35]: Now my hands. Anyway, that that's the first issue. The issue is experience. [3:15:36, 3:15:37]: Having done. [3:15:37, 3:15:41]: First that architect, retired, let's registered background. [3:15:41, 3:15:43]: Worked at Jersey, Philadelphia. [3:15:44, 3:15:45]: Handle all these types of cases. [3:15:46, 3:15:52]: When you start making real private, now you have a level that people have in that immediate gate area. [3:15:53, 3:15:56]: We don't feel safe having to go through there. Finish the walk. [3:15:56, 3:16:00]: Because you've not given it exclusivity. We get closing down. [3:16:01, 3:16:01]: And do that. [3:16:02, 3:16:03]: And we're still paying taxes on that. [3:16:04, 3:16:05]: [11765.9, 11768.0]: Is it now private? Is it [3:16:08, 3:16:08]: Right. [3:16:08, 3:16:14]: That is that has to be taken into account prior to using when there's because I want to pay taxes on an area that I can go into. [3:16:15, 3:16:19]: Got somebody possibly harassing me. I still belong here, do you live no, I don't. [3:16:19, 3:16:21]: But the taxpayer will go through here. [3:16:21, 3:16:22]: So that's my [3:16:22, 3:16:42]: Thank you for the coming president. Okay. So that that's what comes here. You go ahead, sir. Uh in any community, anytime you put up a gate, those roads become private roads. Those roads and roads they have to have air, they have to have resurfaced. Anytime gate any community, those roles become private roles and not because they're not um to be used by the public and negated. [3:16:42, 3:17:02]: Then there are private roles that are gonna be maintained. Uh they count to the city uh six months for any repair or whatever on that it it becomes a private role. Uh on that note, um council we I need for variance. I've just agreed 30 for variance. We need a motion to accept that. Is there a second? I second Ms. Gantt second from Allen and Mr. I'm fairly case. Okay. So you have some city's got four. [3:17:02, 3:17:06]: All right, let's move on. [3:17:06, 3:17:26]: Company KC two three uh zero four council district number two been written a request for a compass of plan amendment to change the future land use design of three parcels parway and walkway from low density vertical use to high residence to allow for mixed residential development. The advocate is uh D. R. Horton, land east presented by Miss Uh Tiffany Holden. Uh [3:17:26, 3:17:46]: Parlando listed below in the landlock fifty seven of district twelve with seven nine point one six total acres parcel number zero three zero zero one zero zero nine zero zero contains seven three five number zero three zero zero one nine five contains three point six three six acres parcel number zero three dash zero one zero zero nine zero zero six contains one point three acres staff recommendation [3:17:46, 3:18:06]: Planning commission recommendations denial. Applicants are requested to the firm on November 3rd was the night. Oh she wants to go back Adam Timidy uh to do that being uh item fifteen. [3:18:06, 3:18:12]: [11893.0, 11902.1]: So um I I hear that would it be acceptable for a representative from a community from the Home Association to speak to every Western African? [3:18:23, 3:18:37]: Why uh well Jesus I guess you just can counsel for that decision. I know how the citizens for community plays into this. That's why indicated that the reason for the referral is to speak to the commun to the community, is that correct? [3:18:39, 3:18:41]: In the driving scenario. [3:18:41, 3:18:57]: Okay, so if the request is is part of the request is to speak to the Homeowns Association big president, then seeing that maybe appropriate. Now I don't know. Um she may not be wanna speak. She's the mean the meaning um the people we with today with the representatives from Mary. She's the meaning of that. [3:18:57, 3:19:07]: I I'm okay with that. Is I was gonna just give them enough to d to weigh in on it. But personally I'm okay with it personally. Well, how about I was gonna spot the t the table until when? Tell ne till the month? [3:19:07, 3:19:21]: How long is that? You want to take the summary eleven meeting then motion you do that and uh and then what have so what a minute. I was like council mentality. I'm okay that I I will make motion if someone has not I'm I'm okay. I'll vote in favor. [3:19:21, 3:19:34]: I heard a motion, I heard a second. No, motion is not basic. Well, uh mayor and council move that agenda item fifteen sixteen be deferred to the December eleventh meeting. Yes. [3:19:34, 3:19:52]: I second. Okay. I'll give Ms. a second. All favor please indicate. Okay. Okay. Okay, got so four votes. That's good. Uh we'll come back on December eleventh, uh, Tiffany. Okay, seventeen. First reading proposal, FY twenty twenty four, operating budget opposite. Uh mister Mr. [3:19:54, 3:19:55]: Uh symmetric. [3:20:01, 3:20:03]: Sound five city manager plus [3:20:05, 3:20:06]: No sir. [3:20:12, 3:20:13]: Uh [3:20:19, 3:20:21]: Can uh determined? [3:20:24, 3:20:26]: This is garbage. [3:20:26, 3:20:29]: First reading the poll, L I twenty four operating capitalists. [3:20:41, 3:21:01]: Good evening, customers. Uh tonight uh we have the first read budget budget presentation. Before you should have a copy of the budget again as part of your package. Um but I gotta read uh 10 slides. And as you go along um with the next read and adoption, I'll uh probably uh make some adjustments and add some slides to it. But um first of all, we'll send the twenty twenty budget. Um there are no post-fee increases for uh trades building. [3:21:01, 3:21:13]: permits um our plan reviews, no increase in utilities, water rate, sanitation rates, cost home water. Um we can see that there's no risk enough for this upcoming year when we know we're gonna have those out next year. There's establishment point seven seven misery. [3:21:14, 3:21:34]: Um top conditional service in the city to include police and public works. Uh there is uh pus additional police requested for the budget. We are also requesting a four percent cost delivery adjustment for our employees. We haven't had they haven't had one three vehicles, but it's like um we do have road improvements and sidewalks part of our budget uh and it's gonna be funded through our spots and general fund and [3:21:34, 3:21:36]: As well as warns to infrastructure improvements continuing. [3:21:37, 3:21:57]: As I mentioned before, uh if you go back to where the city was by nineteen eighty nine, you'll see how we roam. Most of the people sitting in this room on our count moved here between two thousand and two thousand ten. And and Thabbridge had one of his highest growth rates. If you think we are there at thirty six thousand six hundred, our next spike in growth is gonna take us somewhere around fifty one. It's gonna be the next [3:21:57, 3:22:04]: generation of homeowns to move and develop into the city. And as we continue to need to look forward that future growth not with us and start trying to plan for it. [3:22:06, 3:22:20]: The five twenty three twenty-four budget is projected. Remember this is predicated on revenues always. Are you looking at revenues, not expensive? Revenues is going to be a and then you work to have the expenses around revenues. So the three point seven twenty six point seven million five twenty five. [3:22:20, 3:22:22]: Jaska vaan siihen. [3:22:22, 3:22:28]: So you see that there was no quality tax in 2022. They had about 1.2. That was the transfer foundy. The services they gave us. [3:22:28, 3:22:48]: Um and then receivable budgeted six point seven million for that. We do an increase in our loss, which is predicated also on our growth. You will set in the FY24 budget altar you see going up. And as remembered it also working right now because based on our growth, we'll have opportunity for one or two more package doors. And we want to get those in based on our population, we get added additional package. [3:22:48, 3:22:50]: Um [3:22:51, 3:23:11]: Um no. Um pawn shop or standard effect. Based on your evaluation, you get to add additional. No. And then the UFP's that brings us to twenty six twenty seven um projected revenues. Quick jump phone highlights. Um uh person between what we budgeted and all of these numbers obviously because it's in our fiscal year. [3:23:11, 3:23:31]: They are unaudited and will be adjusted as we go forward. But we projected about 582 for um a government budget. And that includes us looking at banking that's trips um to DC as a while lobbying which we were successful again over um two million dollars, three million dollars as part of the appropriations uh under the cust bill this year. Um and as you go through, you'll see that this includes. [3:23:31, 3:23:48]: increases and some decreases in departments based on and those are slight adjustments obviously from the previous year and our expenditures at twenty six point seven actually matches our so there is out at that point which years we go through and try and manage the budget so we have opportunity savings it would then do the general fund. [3:23:48, 3:23:56]: Under twenty four budget, we are looking at um stopping roughly the same. The additional stopping is gonna come with oppositions being requested by public seat officials in the police department. [3:24:01, 3:24:20]: Under our general fund capital breakout, um, we're going to look at spending some different monies in the police department with the flock cameras, additional flock cameras, several new cars, some repairs, uh other equipment and uh public works making some sidewalks improvements, development strips to two hundred eighty eight hundred and fifty. Um with a combined uh general fund of one point five million dollars. [3:24:21, 3:24:38]: Overall, uh and this is we gotta remember this maintaining for all of our capital improvements we have to for those all majority superclicks that are gonna be four two splits on actually in our general fund. So sidewalk improvements and obviously still uh plus six which will come up for a vote as we come to the end of Splus five six plus. [3:24:40, 3:24:44]: Overall funds budgeted uh sixty one [3:24:45, 3:25:00]: sixty one million and remember about nineteen seventeen million of that splash plus funding um LE funds the a confirmation I'll see through the SPLOS program. So we might set that out to be right somewhere around forty something as a week as a split. So we don't close N Splus budget drops considerably the loss of Splash revenues. [3:25:01, 3:25:02]: [12302.5, 12317.6]: Okay, quick so Mr. Blonde, you had a question? And this is for the read, so we still hope the next reading, second read will be November twenty eighth. The adoption of the budget is advertised for December e December eleventh. All right, Mr. Blank, go ahead, please. [3:25:18, 3:25:38]: So with the refund, obviously that'll come off that comes somewhere for REMs. But also you gotta refrain fact that there's gonna be both as the seventy service come online, those actually increase would be on here. We just haven't estimated w how many those subdivisions because we don't know as they come online. But as you know, um D my right next to this will start probably selling units under FY twenty four. [3:25:38, 3:25:54]: How many? You also have the apartments that are line that Mr. Grant just talked about. Those are gonna come online today. But we don't know if it's gonna go online, but we'll actually get similar stuff. The day for development is actually coming. [3:25:55, 3:26:00]: Review right now after get the C that there'd be some off between would give out and um tax and the um [3:26:01, 3:26:19]: The sanitation rate. And remember that's only the last X one year. So we see some growth, probably offset the the payout of those. We'll see some offset there. When we when should we uh see that we're advertising for people to follow that? I think that's already correct on this. Is it we ready advertising for the sanitation rebut? [3:26:20, 3:26:21]: Yeah, we have a time. [3:26:22, 3:26:23]: I'm sorry. [3:26:24, 3:26:26]: Can I poll in best please? [3:26:30, 3:26:46]: It was announced in Henry Hill. It's also posted on the city website and uh it's gonna social media point that I I received all day from a residence about that they were applying its clarification on the proposed rebate between the three so people are informed and they do know it's like I said article today. [3:26:46, 3:26:51]: Those actually pull off all of that. Yes. Okay. [3:26:53, 3:26:55]: Yeah, but for Mr. [3:26:55, 3:26:59]: I just have a comment. I'm very much now interested in bringing um [3:27:02, 3:27:02]: Per me. [3:27:03, 3:27:09]: We were bringing some information to you guys um at our next meeting later and some cost analysis did but [3:27:09, 3:27:13]: Think we'll be able to run the side if we're able to move in that direction. Thank you. Yes, ma'am. [3:27:13, 3:27:25]: No other questions. Thank you, sir. I guess uh we'll be looking forward to uh second reading. Yes sir. [3:27:28, 3:27:31]: Oh Mayor. Hello, sir. All right. Yeah, the presentation in front of you. [3:27:32, 3:27:33]: [12456.5, 12476.5]: I think we skip over just a little bit, even with the first read is considered a public hearing. So I think we'd have to actually ask if there's anything on the pose FY budget. All righty. Uh uh Paul, thank you very much. Okay, anybody from our far left side is uh in uh favor of the for the first public hearing over the budget from this year from the left side. [3:27:56, 3:28:02]: Anybody don't far right? Anybody on my sixty that's good comments from far left. [3:28:02, 3:28:08]: Right. Oh guess. Okay. Come on up, please. Name and name uh address and get himself right. [3:28:10, 3:28:30]: Oh my name is Ann Fields. My address is 329 Chase. Marion Ray McDonough. I um I just had uh request the point about um you're establishing a three seven seven milit is that the signage for the stuff stockage tasks, correct? Or so you're just reestablishing that for what's been approved. Okay. And um you're resting a four percent cost. [3:28:30, 3:28:30]: Just mm. [3:28:31, 3:28:33]: Within the documentation that was presented. [3:28:33, 3:28:35]: The four percent cost of living increases that [3:28:36, 3:28:37]: For the workers or [3:28:38, 3:28:43]: And my last question is they presented two million in and two million out on the alligator, so it was a wash, there was no revenue. [3:28:45, 3:29:05]: I don't know I don't know about two million, two million now. So the amplifier is funded at is projected funded at two million dollars that we pay into it. Right. Remember because we had a retreat. No companies, no these events do not always make with a communities. They're like pox and recognition. You want the pox of creation to actually the intrinsic value of the community. That's why it's built. [3:29:04, 3:29:13]: We had that guy. We're two million dollars for operations at the end of I24. Thank you for your time. Okay. [3:29:13, 3:29:18]: Public hearing is now closed. All right, then uh no need for motion, I think could another reading come. Okay, Mr Becker. [3:29:19, 3:29:39]: And new business we'll talk about homestead exemptions. Yes, sir. If you would flip over the title page, the second page. Yes, sir. Let's talk about the process due to the home exemption. This month, the next mall is maybe muscle. Can choose the cafeteria of of uh various homestead exemptions, what you might like you won't. Then um we work with city attorney to come up with uh resolution for you to approve in the legislature to uh adopt. [3:29:39, 3:29:41]: [12581.9, 12598.5]: The legislature meets January twenty fourth, twenty four, and ask bill each homestead exemption to pick four to be full bills or six to be bills. Governor has the june thirtieth necessary to sign the bill. November fifth residents will actually approve or not approve homestead exemption. If you would turn to the next. [3:30:02, 3:30:09]: January through May of twenty five, residents will apply for homestead exemptions. July twenty five, you'll digest for twenty-five and set your millage rate. [3:30:10, 3:30:26]: Uh digest will deduct the total pay of those exemptions. And so your three point seven seven will bring in less money uh than the this year by the exemptions. In December twenty-five, mayor and council will collect taxes and the residents would actually get the break property tax from whatever homestead exemptions they've approved. Turn to the next page. [3:30:27, 3:30:30]: [12630.4, 12650.4]: You see L one is regular homestead exemption in in Henry County that the in an owner occupied house, no matter what their age is, if file for a homestead exemption, they get four thousand exemption from any military rate levied by the state, fifteen thousand by the county, zero from the school board counseling outland. Heard you mention they got twenty three bills. They don't offer a homestead from their school bond. [3:30:50, 3:31:10]: On the school M and O, they offered 4,000 for home exemption. And the school two is 62. You can see the exemptions there. L three is 65. See the exemptions there. L 6 is 68 and older. You can see the exemptions there. L9 70 and older. See the exemptions there. L 12 will be totally disabled under the age of 65. And go to the right, these exemptions are automatic. [3:31:10, 3:31:15]: They're um in place by George Legislature. You can see the ex amounts they change every year, but the legislature approves. [3:31:15, 3:31:20]: And so you actually howl these home settings no matter what you do, because it's by predate law. [3:31:20, 3:31:21]: Turn to the next phase. [3:31:23, 3:31:28]: Here at the cafeteria of uh exemptions, um I have put together along with his staff. [3:31:29, 3:31:30]: Uh L one, the regular exemption. [3:31:31, 3:31:36]: There are three thousand three hundred eighty eight homes in the city of Stockbridge that get the Henry County exemption. [3:31:36, 3:31:42]: If you offered uh ten thousand, you see the county's fifteen thousand, put ten thousand there for you. [3:31:42, 3:31:45]: It would reduce your taxes by one hundred and seven thousand dollars annual. [3:31:46, 3:31:47]: You can see the neck down. [3:31:47, 3:31:54]: Age sixty two, the hundred and ninety tombs in the sea lips of college park. And by the way this includes the annex Air Well, sir. [3:31:55, 3:32:01]: What'd I say? I'm worried now by beat I know you're worked more than you. [3:32:02, 3:32:22]: Stock bridge. So age sixty-two, Henry County offers fifteen thousand. There are 192 segments bridge. 10,000 what we've prepared for host exemption. It would reduce your tax burden by$7,238 sections. You can see the L three sixty five, there are two hundred and seventy-six present that will qualify for that based on the uh amount that qualify for the Henry County. [3:32:22, 3:32:32]: Exemption ten thousand uh exemption there and just all it's exemption is if you had a hundred thousand dollar house, it's assessed four percent, forty thousand, you would deduct these numbers from that four thousand dollar figure. [3:32:32, 3:32:34]: So it's a deduction from the assessment. [3:32:35, 3:32:53]: Eight state, one hundred ninety six there, fifty thousand there. Uh you had asked or own SIC tank. There are no cities or counties or school boards such an exemption. We put that in there and there's some data that the city has that there are four hundred twenty seven homes in City of Stockbridge that will get that. Eight five thousand, it'd be a eight thousand reduction exemptions. You all c can choose [3:32:54, 3:33:01]: Numbers if you want to go up down and then I can I have an Excel spreadsheet we'll spit out what the numbers be. Age seventy thousand and ninety eight residence stockage. [3:33:02, 3:33:06]: We have a twelve five thousand dollar exemption for A seven D and older it'd be a hundred three thousand dollar reduction. [3:33:06, 3:33:13]: Then totally disabled age six five three five, there's sixty eight resistance operations. We gave twenty five thousand of them at sixty four hundred dollars reduction. [3:33:13, 3:33:16]: And then the ones below are the ones that are automatic based on the state. [3:33:17, 3:33:21]: And so you can see that annually it would three hundred seventy five thousand dollars reduction [3:33:21, 3:33:31]: in the taxes that you would collect, I think I or three seven seven mills up at the top you can see where it brings six million eight hundred and eighty two thousand. So you would take three hundred and seventy five thousand off of that. [3:33:31, 3:33:47]: As you change these exhibition numbers, you make them higher, then it'll be more lower it'll be less. That's mayor. [3:33:47, 3:33:58]: So fifteen thousand is what currently gives. Fifteen thousand is what Henry County currently gives for that exemption and the manager and I just picked ten thousand for you. There's no magic. You could pick fifty twelve or more or less. [3:34:00, 3:34:13]: And part of our assess was and you all set the miller seven seven mills at real skinny amount. And so you already gave all the residents, no matter whether they had a home dead exemption or not, lower millage rate than the last would get. If you remember we recommended a higher amount. [3:34:13, 3:34:21]: Yeah, I I got the but she's gonna look at Henry John Ray. I wouldn't like the uh post that on the case. So just put the exact number in [3:34:22, 3:34:39]: Like I've said before, you when you bring citizens into the city, they got all the tax interests with the county. I understand it but they we invite them, but it just becomes uh interesting when now they're paying uh for an area they didn't have to be that makes any interest. [3:34:39, 3:34:45]: So I'll run where we make your exemptions exactly equal what county gives. Not to what number is. [3:34:49, 3:34:50]: While I'm doing that, we can take other questions. [3:34:51, 3:34:58]: I I don't know the question right now, I gotta s you know, kinda read this and kinda stick it in a private device or question full a little later. Anyway, Mr. Zanguy, sir. [3:34:58, 3:35:18]: That my point is keep us we set the millage at three point seven seven, which is the lower possible. So certainly uh what may end up happening is we certainly wouldn't want to have a re vote to raise raise taxes uh after sitting the millage at three point seven seven. So might be vote to um'cause'cause given everybody [3:35:18, 3:35:29]: Basically homestead uh exhibition with a three point seven lowest rate possible. Might it be possible to just uh maybe apply for it and then not have it apply until maybe the following year. [3:35:30, 3:35:44]: Yes, sir. Mayor. So uh councilman Blount I went in and gave the exact name stock bridge which is a county down at seventy and totally disabled. I lowered those twenty five thousand dollars to fifteen thousand dollar amount and all that total now is forty four thousand versus three seventy five. [3:35:47, 3:35:48]: Yes, sir. [3:35:49, 3:35:51]: Okay. [3:35:55, 3:35:58]: With East because brought in some minutes from the [3:35:58, 3:36:04]: from the uh uncovered areas that release off what they've already been using. That's how it gets quite [3:36:04, 3:36:07]: They're paying well a tax. [3:36:07, 3:36:09]: But they didn't have all the VS stuff. [3:36:10, 3:36:25]: And think that with with the amount that you're talking about. Uh it's a fact that it's lower than I thought of. Me too. That's why I hope I would hope I would hope that this council would have been a member to to actually bring the amount at the same [3:36:25, 3:36:38]: uh footprint of this if a more blueprint will be channel uh that would be the future argument for anybody to say hey this is the same foot blueprint that you're dealing with economic before you came to see the doctor. [3:36:38, 3:36:47]: I would like to have this council, either in November or December, actually approve what said exemptions are so we can ask legislators to get started in January. [3:36:47, 3:36:55]: All right, so what I guess so it's on us so I guess to whether or not do it later on at work sessions month or do it the at this eleventh uh meeting that we have but we're gonna face now. [3:36:55, 3:37:10]: Well, Mill, um I think that there was a a wish put on the on the Conservative Council feels that we should match everything that Henry County matches. Then realized that that total other than what was recommended by us was four hundred and four versus three hundred and seventy five. That's the wish of council. Um [3:37:11, 3:37:31]: It's roughly twenty seven twenty seven dollars. So if that's the we'll put we'll we'll put that up um together and that's what we'll send to the state for them to ratify and if they do put on the November ballot twenty twenty four and effect twenty two five. And what we'll do mayor is prepare a resolution with city attorney that had you approve a resolution. Right. [3:37:31, 3:37:51]: Legislation. It wouldn't be in effect in twenty twenty four in the right. So that's my thing. I know we're talking about you know a hundred thousand dollars. That's a big that's a deal with what we are in terms of uh [3:37:51, 3:37:51]: Well. [3:37:52, 3:38:12]: Well, i if you if you do it four hundred thousand as a percentage of your overall budget is very is low below percent overall, right? Um percentage um but uh point eight percent. Well three point seven seven was uh was basically a balanced budget though, right? And and and I and yeah, and so understand that if [3:38:12, 3:38:17]: But now back in a deficit. [3:38:17, 3:38:19]: So you'll have deep data in it. [3:38:19, 3:38:20]: The the new [3:38:21, 3:38:24]: Well you can f you talk in four. [3:38:24, 3:38:29]: Right. But what I'm saying is whatever you boot, is it three seventy five or four four or five hundred [3:38:30, 3:38:38]: That's predicated on values being out times the military. If those values stay the same or drop, basically danger in the economic risk, your president's election next year, right? [3:38:38, 3:38:42]: And based on the skill of a economic change and outlook. [3:38:42, 3:38:56]: But we're talking next year. Mayor, if you don't mind. I just want to make sure that you understand whatever you want to do. But I understand it, but what what but what I'm saying is if we can stand up here and we can prove this and approve that, we can pay we pay seventeen thousand dollars last week for license. [3:38:56, 3:39:16]: But we're talking about something like homestead exemption that especially the citizen we brought in. And then but we only we're not talking about four thousand dollars, we're talking about two thousand five thousand dollars on top of what was already present. No, so this is what was recommended that five thousand is not there currently. This is just our recommendation. Right what I like to think about if I can quantify for you in terms [3:39:16, 3:39:36]: terms, four hundred four thousand is equivalent to point two two mils. All things being the same, if you grant the exemptions, you need to go up from three point seven seven to to whatever three point seven plus point two is. But the reason I'm the reason I'm saying this because I thought that three point seven seven meals was all staff to to drop the trash. Not saying that, you know, not in [3:39:36, 3:39:52]: And the l what I mean about whatever spending that we have, that we we we we remove that and we look down the line on everything and pertain to spending staff members we uh whatever we need to do. That's what I thought it has to do. Mr. You got you got to I was kinda going. [3:39:52, 3:39:56]: Okay. [3:39:56, 3:40:11]: Yeah, yeah. Uh until council and as we grow or we exceed the number. I I keep wanting this council to understand you have equal income, you will add people and new things to the city. You will not be raised in twenty twelve or two thousand. [3:40:11, 3:40:14]: Keep an eye on you on your way to fifty thousand people. [3:40:14, 3:40:22]: The city is growing. The wants and the needs are different from where they are today compared to where they were a few ago. When I moved here in two thousand, Paul Stevens could be a loaded I want. [3:40:22, 3:40:23]: Two years [3:40:24, 3:40:42]: Indeed prepare. That's gonna happen everywhere as time goes on with our development. I just want to keep the council. Yes. We certainly keep the residents on it and it's up to the council to determine which one that's when we move forward with as the council we do take that home example. Yes. We do have rent who need that relief and and obviously to the city. I hardly I just want everybody to understand there's a cause and effect, right? [3:40:42, 3:40:45]: If you if you give them citizens this your degree should should happen. [3:40:46, 3:40:48]: Recognize that that comes off whatever top you collect. [3:40:49, 3:40:51]: Whether it's un or ten percent, you give it back. [3:40:51, 3:40:53]: That's it. [3:40:53, 3:40:56]: That's gonna back into the road. We'll increase those ex somebody do. [3:40:57, 3:40:59]: Right. We see a a rise of digest. [3:40:59, 3:41:00]: And date schools. [3:41:00, 3:41:01]: Really road back. [3:41:02, 3:41:06]: Or you can still give more to residents. Those those options are gonna be open to us as we go forward in time. [3:41:07, 3:41:13]: But yes, they need the reliefs. Whatever that relief is, we'll work with that numbers, recognize doesn't correct. [3:41:13, 3:41:25]: This year then take back twenty four, th those tax exemptions take effect in twenty twenty five. That's when they come to fair. I'm gonna agree with you on and I understand that and I get it. But [3:41:26, 3:41:28]: Every year that I've been on. [3:41:28, 3:41:39]: I have s waste in the butt. I've made a recommendation. I see you shaking your head. That's no, I agree, but y you could just not every in this council know that. But we have chose not to cut Blount. [3:41:40, 3:41:40]: They at least. [3:41:41, 3:41:43]: And last year the year four. [3:41:43, 3:41:52]: I ran over a million dollars in saving and cuts, but we we didn't do that. So I'm just saying that media equal up to the satisfaction for both. But I'm just saying. [3:41:52, 3:41:54]: We waste a lot. And and [3:41:56, 3:42:03]: You're right. You know, you could go in any budget f find what you potentially see as waste. About what this council understand. [3:42:04, 3:42:19]: You own a private business. Business is a public business. You buy services. Yours public business goes. Yeah, and I'm gonna agree with you. I really do. I just wanted I s I wanted to make sure I say this in on the record because I want to make sure you heard what I said. So and we But the council, as you know, once [3:42:19, 3:42:20]: Were you four months? [3:42:21, 3:42:23]: We got if you have any recommendations, please send them to us. [3:42:23, 3:42:27]: The budget was in the council in July. We went over the uh August East. [3:42:28, 3:42:29]: Budget retreat. Well you don't mind [3:42:30, 3:42:32]: But and and this is one other thing I was [3:42:32, 3:42:37]: If we want to be the against the Rodwells and the Alfred and so forth, we want to be able to make it a little better. [3:42:38, 3:42:40]: I I play as council academies made up the budget. [3:42:41, 3:42:43]: This part is Julian Montpellier Winnie, it's done. [3:42:43, 3:42:47]: They've gone through the cuts, they've gone through the process, and they come to the read of the budget, you don't see the bunch of numbers. [3:42:48, 3:42:49]: Coloque o virou um bonito. [3:42:50, 3:42:51]: No sound your comment. [3:42:52, 3:43:12]: Let me just say Mr. Blount, I agree with everything said. I'm not opposition to anything you said. I certainly support it. Uh I want the home stakes if you come, but I did want to make sure that we made a point that it leave somewhat of a hole there. But certainly I'm gonna vote for every opportunity to give the citizens uh relief uh that they ask for. Um in defense of the city of Durance Council vote [3:43:12, 3:43:17]: Everybody can make suggestions, but we vote and we have in order to ratify any change. So he makes a [3:43:17, 3:43:37]: Thank you for putting the budget together, but we have to have three vote to approve any any changes to the budget. So we have to say we have to accept whatever there is or whatever the changes is because three votes vote to approve the final budget. So any of us have to get consensus among our group. So incident puts the budget together, but we vote uh three of us to approve it for any change. [3:43:37, 3:43:39]: Correct. [3:43:40, 3:44:00]: Yes. That's how it works here. So I might make some suggestions many of us make suggestions. We gotta have three votes so that it may happen. So thank you. So asking for this is to come up with not we just gave you a resolution and we don't forward for so for approval or send approval and whatnot, and that is going to be at end of the work session this month or that in December. We can bring in the work session. We have enough time we can make things necessary. I mean we literally did the spreadsheet. [3:43:59, 3:44:17]: Okay. Yeah, yes sir. I would like to see uh if any way possible to have those numbers ones of the uh Henry County because it's not that big of a difference in in it in the function. [3:44:17, 3:44:18]: With half a hand. [3:44:18, 3:44:20]: I'd I'd go back to [3:44:20, 3:44:26]: Yeah. Uh you know, it's a task standard to make that happen. [3:44:26, 3:44:33]: Uh if it's it's not enough, it's fifty thousand over then we save fifty thousand dollars square a year. We c and cut the home that is. [3:44:34, 3:44:54]: All right. So comments.
