Uh as you know at our last meeting [0:22:15, 0:22:22]: We went over the chart that was submitted to us by a financial advisor outlining the [0:22:23, 0:22:37]: um exemptions options, uh and they will go L one, which is similar to all of the exemptions that are offered to Henry County. Um staff council asked staff to revisit the numbers, which we did with the financial advisor. [0:22:37, 0:22:45]: And we've got exemptions, regular exemptions as homeowners for ten thousand. They're currently at five thousand fifteen thousand with the county. [0:22:46, 0:22:47]: Uh age sixty two. [0:22:48, 0:22:54]: Ten thousand, eight sixty five and older, ten thousand, eight sixty eight and older, ten thousand septic tanks, five five thousand. [0:22:55, 0:23:15]: Age seventy, ten thousand. Uh disabled veterans, sixty-five and over ten thousand. The impact uh we discussed would be right around three hundred and six thousand forty-one dollars. Um that would impact the FY twenty-five budget. That's a year from now, not this year, not the current current year. Um obviously the [0:23:15, 0:23:25]: The process is once this is out voted on by the council, we will then submit this to our delegation, local delegation to the state representatives and Senate. [0:23:25, 0:23:26]: Labeled in [0:23:26, 0:23:46]: appropriate a bill under their requirements. Um that will then give us an opportunity once the governor signs that bill and it's passed through the House and the Senate. Go to the governor's desk. He will sign it. There will be a referendum on the 24, 2024 general election calendar, November of next year for citizens [0:23:46, 0:23:54]: To vote to accept the homestead exemption. And once that's done, if it's approved, we'll take effect uh April 2025. [0:23:55, 0:23:58]: Thanks, sir. And questions for counseling questions for Mr. Gardner at all? [0:24:01, 0:24:02]: Oh, go ahead, please. [0:24:03, 0:24:05]: Mr Gardner. [0:24:05, 0:24:07]: For the septic systems. [0:24:08, 0:24:12]: The headcount of four twenty seven, is that the number of households? [0:24:15, 0:24:22]: Yes, ma'am, I think that's the projected number of of households that that would would get that award if approved. Thank you. You're welcome. [0:24:22, 0:24:36]: If there are no other questions, uh council, I need a motion. I just want to confirm we had discussed a couple of options. This is the one that'll have the least impact on the budget. That is correct. Correct. So I'll make a motion for approval. Okay, thank you. Uh Mr. Alison is there a second to the motion. [0:24:38, 0:24:39]: Is there a second to the motion? [0:24:45, 0:24:52]: All right. There's no second emotion, ladies and gentlemen. All right, from Mr. Alzheimer's and Ms. Barber. And what we have before us uh deals with annexation case AX2023-03, which is located in district council district five, consideration of request for annexation of property, a property of 77 and 87 Holloway Road. [0:27:30, 0:27:32]: The front is on Patrick Henry Parkway. [0:27:32, 0:27:52]: Located in unincorporated Henry County into the city limits of Stockbridge. [0:28:05, 0:28:20]: And once again, let's see here, we have the rezoning case of um rezoning case RZ twenty twenty-three-zero four, once again located in Council District Five, and request to assign the zoning district of PUD Plan Unit Development. [0:28:21, 0:28:24]: Two parcel of seventy seven eighty seven Holloway Road. [0:28:24, 0:28:44]: Frontage and the park on Henry Parkway, located once again in c incorporated Henry County, and if and after parcels are annexed into the city limits of Stomp Ridge. Mr. Ryan, please, Anderson. Good evening. I'd like to remind um the audience that these are three related cases and we'll be doing one presentation. [0:28:44, 0:28:46]: For the forty three cases. [0:28:51, 0:28:51]: Wow. [0:28:54, 0:29:03]: This is a request to annex property at 77 and 87 Holloway Road with frontage on park on Patrick Henry Parkway. Uh it's 14.16 [0:29:04, 0:29:15]: It's two acres. The current use is vacant with a single family residence on eighty-seven Holloway Road. The current county zoning is RA. The county land use designation is mixed use. [0:29:17, 0:29:18]: Uh do cannot. [0:29:20, 0:29:21]: Above on the [0:29:23, 0:29:38]: slide you can see that um a copy of the um other of the subject property. 87 Holloway Road is right here. Um to the north of the property you have the encompass help rehabilitation hospital of Henry. [0:29:39, 0:29:43]: And seventy seven Holloway Road is just south of eighty seven Holl Holloway Road. [0:29:45, 0:30:05]: um adjacent properties on his properties to the north you got rm multifamily residential r a residential aquaculture districts to the south of the of the sites you have rr rural residential city of stockbridge c three heavy commercial district to the east of the property you have rm multifamily residential [0:30:05, 0:30:11]: And to the west of the property you have R R City of Stockbridge, OI Office Institutional City of Stockbridge. [0:30:13, 0:30:16]: Here is a joint zoning map of the of the property. [0:30:17, 0:30:22]: They have joint county and city zoning all on one map. You can see that there are [0:30:24, 0:30:35]: related zoning and that the that it wouldn't be a spot zoning and that the proposed use that is pro being proposed for mixed use development by the applicant is compatible with the existing neighborhood. [0:30:38, 0:30:58]: Surrounding uh land use designations. To the north you got the Eagle Crest subdivision, which is high density residential, which is what the applicant is requesting. To the south you got vacant land, vacant land, but the land use designation is medium density vertical mixed use and mixed use here in county. Mixed use is also compatible to what the applicant is proposing. [0:30:58, 0:31:18]: They're proposing a rezoning the PUD, which is the same as Henry County's mixed use. Property to the east, you got Eagles Crest Subdivision and Eagles Landing Middle School. The land use for both of those sites are high density residential, and the school is park, recreation, conservation. Sorry, property to the west. [0:31:17, 0:31:37]: You got vacant land and you got the encompass health rehabilitation hospital of Henry. You got medium density vertical mixed use land use stock bridge and high density residential uh Henry County. The applicant is proposing high density uh land use designation, which also means that it's compatible to the existing. [0:31:37, 0:31:39]: Land use. [0:31:41, 0:31:51]: Here's the joint future land use map. And you can see all by the colors that the applicant's proposal is compatible and consistent with the existing land use in the area. [0:31:56, 0:32:08]: Project information the developer pro to propose to build a mixed residential development with 136 units, including ninety-two single-family detached rental units and forty-four duplex. [0:32:08, 0:32:14]: rental units. In addition, the development will include a dog park, pool spa, and a gazebo. [0:32:24, 0:32:44]: The um the subject property is is contiguous to the city of Stockbridge, which makes it eligible to be annexed into the city. As a result, Steph recommends approval of the annexation. As it relates to the uh rezoning, the subject property, uh the proposed rezoning that the city will assign a PUD is compatible with the existing. [0:32:44, 0:33:00]: existing land use in the county or mixed use. So that is compatible and um and it's compatible with the existing zoning in the in the neighborhood. So staff recommends approval of the um of the comp plan and approval of the rezoning. [0:33:03, 0:33:05]: So I covered um all three cases. [0:33:06, 0:33:20]: Thank you. Um the applicant is here obviously. Uh next uh bat uh next uh metro acquisition. Uh or Miss Battle. I didn't know if you wanted to add anything else before we go into conversation with the council here. [0:33:20, 0:33:21]: No, sir, that's it. [0:33:21, 0:33:22]: Okay. [0:33:23, 0:33:24]: On that [0:33:30, 0:33:50]: Thank you. I have a couple of questions of the staff. Okay. Go ahead. Go ahead. Yeah, Mr. Sir thank you, Ryan. Well Mr. Anderson, we appreciate that. Now certainly uh you've reviewed this project uh in detail and you've worked hand in hand uh [0:33:50, 0:34:10]: So trying to make sure that everything complied with uh the city zoning code and um the new development code that we've established for the city, is that correct? Yes, sir. Okay, certainly I think um this development is a should not be viewed as a standalone. [0:34:09, 0:34:29]: It should be viewed as the comprehensive part of the comprehensive master plan for Patrick Henry Parkway, which is uh an overall plan, which we'll be discussing uh later on uh in with a with a with another rezoning that we have coming up further. [0:34:29, 0:34:49]: So when you look at this in isolation, you see it as just this solo project. But in essence, what it is is an attempt by the city to improve this area and make sure that nothing but excellence uh would be would would be brought into the area. It limits what other types of uses, especially unit. [0:34:49, 0:34:53]: Exactly. Yes. [0:34:53, 0:35:13]: And future before we established this and we went down uh even with the future master plan, we had uh Henry the Henry County had a Johtoco North and a Johtoco South for this particular area that they had already uh put together and we're uh basically kind of revising that. [0:35:13, 0:35:16]: This project was actually in keeping with that as well, correct? [0:35:16, 0:35:21]: Yes, sir. We recommend all the um recommendations that Henry County had associated with this property. [0:35:22, 0:35:35]: Absolutely. And it is true uh as well that Henry County has a three hundred plus unit um luxur uh apartment complex under construction along Patrick Henry Parkway now, is that correct? Yes, sir. [0:35:36, 0:35:40]: It was told that us that there was a discussion about this area area. [0:35:42, 0:36:02]: Only having medical but by uh Henry County official, but they have that that project is under construction right now on Patrick Henry Parkway. So if the desire was to make it only medical, then why would they do that? [0:36:02, 0:36:11]: We understand what we're trying to do is keep it in keeping with what we're trying to go uh with our comprehensive plan for the city. But I thank you. [0:36:12, 0:36:12]: Uh thank you. [0:36:13, 0:36:33]: Right. Uh on that note, Council, any other questions from the council you may have at this point? Yeah. Go ahead, sir. Yeah, real quick, Ryan. Uh I think that was one of my concerns is that with this project, uh, and I did speak to uh District Five Representative Ms. Alexander, is that it staked uh with the same conditions we've left [0:36:33, 0:36:50]: On other developments, um be material and everything else pertaining to that. I just want to make sure that the precedence that was set, this is adhered to that, what I was happening to dissect it ourselves, that that it that this is also put in the um [0:36:50, 0:36:56]: Yes, sir. It will ha it would be it would be um be comprised of high quality m uh materials and uh [0:36:56, 0:37:05]: And follow all the other um conditions and regulations and requirements of our UDC. With the building percentages and all of that. Yes, sir. Thank you. All right. [0:37:06, 0:37:09]: Hi, Ms. Battle, do you have anything you wanna add at this point? [0:37:16, 0:37:17]: There it is. [0:37:19, 0:37:37]: Good evening, everyone. Good evening. Let me see if I can get this a little closer. Michelle Battle with Battle Law, 3562, Habersham at North Lake Tucker, Georgia, 30084. It's always wonderful to be here in front of you all tonight. Um I'm gonna put up the PowerPoint that we have. [0:37:41, 0:38:01]: I think staff has done an excellent job of describing the project. Um, what I want to do is just add a little bit of extra um to the pot. And if we can get here, great. All right. Um Avila is um next metro community is building um this proposed project. This is one of the first projects. [0:38:01, 0:38:06]: projects of this type that will have been built in the Metro Atlanta area. [0:38:06, 0:38:26]: It is a very unique product that they are proposing, and we'll go into more detail about that. But the first part is this annexation request. We believe that this annexation is in alignment with the vision that the city already has along Patrick Henry, while the property currently is zoned RA. [0:38:26, 0:38:46]: We are asking for an intensity an up upping the intensity in the land use designation for the site to be consistent with the city's vision along the corridor, as well as, quite honestly, the county's stated vision in its comprehensive plan as well. The property and [0:38:46, 0:39:06]: As already indicated, is located around along this mixed-use corridor. We're down in this area right below the rehab facility before you get to Jodoko Road. And we know that the city, again, as Councilmember Alexander has indicated, will be looking much more closely. [0:39:06, 0:39:20]: at this corridor as you all continue to grow the city and grow this particular area, which will have a mixture of uses, including retail, office, multifamily, single-family attached townhomes, and the like. [0:39:21, 0:39:32]: In terms of this particular project, I think that the video that we have will actually best describe the product type, and if I can get it to go on here. [0:39:33, 0:39:36]: apologize, I'm trying to get rid of these little [0:39:37, 0:39:43]: That's at the bottom. Let's see if that will start it. I may have to ask your IT person to help me out a little bit. [0:39:44, 0:39:46]: Okay, is he here? Where are you? [0:39:49, 0:39:49]: I can't. [0:39:52, 0:39:58]: Let me see here. Oh wait a minute, that might've been that might have done it. Perfect. You can watch this. [0:41:31, 0:41:51]: So the product that we're looking at here is a single story detached cottage style homes that will be rental community and it will be maintenance-free living. This is a real choice that is made by the individuals who'll be living within this community. Um as we know as we're in this housing crisis that there are many people [0:41:51, 0:42:11]: Who have made the decision to actually rent as opposed to own. And so while the city continues to grow with its single-family, detached fee simple product, this product is actually kind of that in-betwixt and in-between space. Those who don't pref who don't choose to live in [0:42:11, 0:42:31]: A high-rise apartment complex that may have, say, a dog or have other desires to be able to have kind of an outdoor space with their home. These individuals will have a backspace, a backyard space where they will be able to go outside, to grill, to have if they [0:42:31, 0:42:51]: They have a dog or a cat or an animal, they will be able to be out in a fenced-in area located within their home. So it really is a different type of a home style where people are renting these cottage homes for in in many instances long term. A lot of times what you'll find is that [0:42:51, 0:43:08]: Um they have seniors who will um make the decision to sell their primary home and move into this um type of a community. There's also many who are in the medical profession and we'll show you some of the other information about those who tend to come into this type of space. Um [0:43:10, 0:43:30]: When we go to the next slide, um, again, these are renters by choice. Many of them have the financial means to buy a home, but they've chosen not to at this point. And so the majority of the residents here are either professional millennials, midlife singles, dual-income couples, or empty nesters. The age um 58% are 35 and older, 23 percent. [0:43:30, 0:43:50]: Are typically 55 and older with an average household income of$132,000. Minor occupants typically they don't have more than about 20% of those in the households being children, mainly because, again, this is really a product that is geared towards. [0:43:50, 0:43:52]: Yeah. [0:43:53, 0:44:07]: Again, we show some portfolios about the average household income. Um, this product has proven itself to be successful in areas such as Arizona, Texas, Colorado, uh, and Florida, and that is why the desires to move into the Georgia market. [0:44:08, 0:44:28]: From marital status, um, most of the individuals that they have found in these communities by taking um polls in the communities that they have, um, most are single at uh 45% are either single, never married, or singled, widowed, separated, or divorced. Um roughly forty-three percent are married, and then twelve percent. [0:44:28, 0:44:30]: and are partnered in some way. [0:44:31, 0:44:50]: Number of children, again, the average household within these communities typically have no children living in the household, roughly 80%. The balance has one, two, or three children living within the community or within the household. [0:44:50, 0:45:10]: Staff um in terms of the site plan, we do have frontage along Patrick Henry. There are two points of entry. Um, one is a full service entry, one is, I believe, a right-in, right out. Um, we will be placing um amenities along within the community. Um, as you enter into the community, we will have the 10 um foot uh multipass. [0:45:10, 0:45:30]: Sidewalk that has been hailed by Commissioner I mean Councilmember Alexander. It's something he has pushed very hard to make sure that you have um kind of walkability along this portion of Patrick Henry as it will connect into the other sidewalks that will be developed along this corridor. When we get into the interior [0:45:30, 0:45:50]: Of the site, we have the leasing office, and then you've got both single-family detached cottages and duplexes. So they're a mixture of those throughout. The units are one, two, and three bedrooms. The one bedrooms will be at$18.50, roughly the opening rental cost. [0:45:50, 0:45:57]: The two bedrooms will be at 2200 and the three bedrooms will be at 2500 per month. [0:45:59, 0:46:19]: Um one of the things that we did modify since the last uh hearing before Planning Commission was the relocation of the dumpster pads. Initially, they had been located along the perimeter of the site adjacent to the residential homes. Those have now been relocated. Um they are now on the opposite side, which is adjacent to [0:46:19, 0:46:21]: to the rehabilitation facility. [0:46:24, 0:46:41]: When we look at the housing styles, um they will be a mixture of textures, um, board and batten, um, other fibers say fiber cementaceous materials, um, as well as either brick stone brick or stone around the water table, and you can see here around the pole. [0:46:47, 0:46:57]: And one of the things that we wanted to point out, um, because I need to go through the proposed conditions um that staff had set forth um in your package, is that um [0:46:57, 0:47:17]: The staff had recommended that we provide dwelling facades having separate styles and colors for the one, two, and three bedroom units. We actually will have each plan will have roughly three elevations or more for each of the planned plan types. And so the duplex, the two-bedroom. [0:47:17, 0:47:37]: And the three bedrooms are all have three elevations, each equaling nine different elevations throughout the community. So we don't want everything to look identical. It is not intended to kind of look like barracks. This is a community. We want people to be able to come in and see the aesthetic appearance. [0:47:37, 0:47:46]: Appeal of the community as well. And so there will be different styles with different textures, different colors, and the like. [0:47:47, 0:48:07]: Um in terms of security, that was one of the other issues that came up during our prior public hearing. Um what we know is that when people purchase a home, typically they don't have to go through any type of criminal background check. Um there's none of uh that when you're purchasing a home. But in this case, because this is a multifamily development. [0:48:07, 0:48:27]: With one developer owning the entire community, there will be criminal background checks as well as other community safety measures that will be put in place. They do a premium national criminal search, including felonies and misdemeanor convictions, national sex offender registry search, terrorist search, and [0:48:27, 0:48:47]: Additionally, they also follow best practices and run supplemental county-state criminal searches as well. Their residents are at a minimum in terms of income ratio, have to be 2.5 times the rent. Credit is run with typical credit bureaus. If you have a felony, there's an automatic [0:48:47, 0:49:07]: Denial. If you commit a felony while you're a resident, they do have the right to evict, and any criminal activity, felony, or misdemeanor on property will automatically evict. There's fencing around the exterior of the property, and there will be gated access to the community. In your package, you [0:49:07, 0:49:27]: would have received the staff's recommendation. There are only a couple of things that I wanted to highlight that we um asked um to be amended. Um the first um regards to the parcel recombination. Um in the staff report it had indicated um that this zoning would not be if it is approved would not be final until [0:49:27, 0:49:46]: The parcels had been combined and we have asked that that language be removed, that it simply start that no permits shall be issued by the city until the developer provides to planning and zoning that the two parcels individually have been combined. [0:49:47, 0:49:49]: When we get to the site plan [0:49:50, 0:50:10]: Um there is um one slight change, which is that um we submitted a site plan with um a March twenty-ninth, twenty twenty-three date. Um the plan that we just presented to you did relocate um the dumpsters. That was the only change. Um if that is [0:50:09, 0:50:21]: Simply stated, I think we'll be fine. Um, but if you need to make reference to the plan that I just showed you that has a last revised date of November thirtieth. In terms of the amenities. [0:50:22, 0:50:42]: Um we were very, very specific about the types of amenities that we wanted to offer in this community. Um and that includes a resort-style pool and spa, a game lawn, a grill pavilion, a fire pit, a dog park, and an indoor multi-purpose um room. And so all of those will be [0:50:42, 0:51:02]: Be provided, and we would much prefer as opposed to the provision that's currently in the conditions that makes it open and broad, that it will be additional amenities as determined by staff. We would prefer to be able to say that we will be providing that resort-style pool and spa, the game lawn, the grill, the fire. [0:51:02, 0:51:10]: Fire pit, the dog park, and the indoor multi-purpose room, all is reflected in the um uh site plan. [0:51:11, 0:51:31]: Um I've already made mention of the architectural design component. Um it doesn't matter whether we leave it in or not, but we actually have already obtained the easements necessary for water and sewer availability, so we don't actually need a condition with regards to that because that has already been addressed. Um there will be a [0:51:31, 0:51:51]: um property management company. Staff in here had a homeowners association. That is only for a fee simple product. So we just wanted to make it clear that we will have property management on site. We've also agreed to have a 10 the 10 foot path along Patrick Henry and agreed to the masonry wall. [0:51:51, 0:51:59]: Also shown in the site plan, which was already presented to staff with that March 29th date. So we think that those things are already kind of [0:52:00, 0:52:00]: Um [0:52:01, 0:52:21]: assumed within that site plan, but we just wanted to make sure that that was clear that we are doing those things. So with that, um probably the only two or three that really need to be addressed from our perspective is not having the plat or this rezoning if it is approved, final, only [0:52:21, 0:52:41]: Upon the recombination. Instead, the recombination is just another condition that we have to meet before the LDP is actually issued. We'd like to be able to state specifically what our amenities are going to be, and we would like to have addressed that the architectural style that we will be required to have three elevations. [0:52:41, 0:52:57]: Each um equaling nine different elevations throughout the community. And we are here to answer any further questions that you may have. Thank you. Thank you for your presentation, Miss Battle. Really appreciate that. And on that note, let's start with Mr. Alexander, sir, please. Yeah, Ms. Battle, if you would come back [0:52:58, 0:53:18]: Let's look at the uh the uh the layout of the community. And we had some discussions about uh the tr the interior sidewalks as trails so the residents would be there would be some walkability inside the development that is correct, so that those would not just be stuck. [0:53:18, 0:53:27]: standard five-foot sidewalk that they would be wider so that residents could bike along that or jog along that if they needed to. [0:53:27, 0:53:47]: I believe that the sidewalk is six foot um um in the interior. Um there are sidewalks throughout the community. You could kind of see that from the um video that we showed. Um and so we feel that we are honoring what you request. Okay, so you got six feet. Okay. Yes. All right. No s they wouldn't be standard five. Okay, that's hold on. [0:53:53, 0:53:58]: And sir, when you come to the mic, please uh This is Sean Rust with Next Medical. I don't know what who you are. [0:54:02, 0:54:02]: Okay. [0:54:02, 0:54:03]: Yeah, that's right. [0:54:04, 0:54:05]: Okay, we're fine. Six. [0:54:05, 0:54:25]: That that's what we want. We want walkability, want people to be able to bike on it uh if from inside out to be able to connect with the ten foot multi-youth path. And also we want to specify that the um the ten foot sidewalk is to be along b the frontage on uh Patrick's [0:54:25, 0:54:42]: Henry Parkway and you have frontage on Holloway Road too, correct? No. We excuse me. You have a small bit of frontage on Holloway Road. The one on Holloway Road would need to be eight feet, not uh ten feet. So it'll be smaller'cause of a smaller secondary road. [0:54:44, 0:54:44]: Okay. [0:54:45, 0:54:46]: Uh [0:54:46, 0:54:49]: Did you ever have that in your plan or is that something we need to to add in there? [0:54:50, 0:55:10]: No, that would ready there. Shawmrus, 270, Turnbridge Circle, Peachtree City, Georgia. Uh that would be something that we would need to add, I believe. Yeah, because right now you didn't have any side you didn't have a sidewalk on that side. We just need to add to make sure we want walkability all the way around. We want to make sure that we do that because when the next neighborhood [0:55:10, 0:55:11]: [3311.5, 3331.5]: Or the county decides to put sidewalk down Holloway Road. We don't want to be that we want to go ahead and get that started so that one day residents will be able to leave that complex, take their bike down Holloway Road to the school to the high school and to the uh middle school uh in that area in a safe [0:55:31, 0:55:46]: safe and effective manner. So I appreciate that the community is gated, correct? It is. We gated entry, both sides entry. Uh uh street lights in uh the the interior, the street lights in the interior. [0:55:46, 0:55:46]: Yes, sir. [0:55:47, 0:55:53]: Okay. And okay, uh okay, I'll ask the next question of staff. Thank you. [0:55:53, 0:56:01]: Thank you. I appreciate it. Ms. Mr. Blount, go ahead, please. Yeah, uh the question is uh you guys mentioned were you finished, Mr. Amazon? [0:56:02, 0:56:22]: The only other thing is we've been as we're going, we're going to modify our uh zoning codes that we re start requiring uh flock cameras for the protection on the security side. So certainly I would like for you to we i if you would be so incumbent to do so, that would be great. [0:56:22, 0:56:24]: Yes, I add in the flock. Where would the cat? [0:56:25, 0:56:30]: Where were the cameras? At the front entrance? At the entrances. Yes. Okay. Okay. [0:56:31, 0:56:38]: So you're good with that as well? Yes, sir. Yes. Okay. They agreed to that. All right. Yes, sir. All right. Go ahead. Mr. Blount, go ahead, please. [0:56:38, 0:56:46]: Yeah, on the um the management, uh on site management. So the on-site management would be responsible for [0:56:46, 0:56:49]: Everything. Everything, yes. Yes, sir. [0:56:50, 0:57:07]: Um the common areas, making sure that all the units are um in proper working order, facades, everything. They are responsible. Lawn lawn, amenities, one person, one management company. If there's any challenges, all the city has to do is contact the property management company. [0:57:07, 0:57:08]: Okay. [0:57:10, 0:57:22]: Any other questions, Council? Mayor. You go right, please. Just for clarification, everything means the residential homes, correct? Yes. Including civil bonds. Everything is manic. Everything is taken care of. Okay. [0:57:23, 0:57:24]: Any other questions, Council? [0:57:26, 0:57:46]: All right, so with uh no problem. So otherwise you agree to those additional things. Okay, on that note you can probably have a seat at this point. I'm gonna open up the public hearing to the to the audience here, to the residents here. All right, ladies and gentlemen, we're gonna open up the public hearing, and this way uh you have an opportunity to say yay or nay, especially your opinion one way or the other. And so we're gonna [0:57:46, 0:58:05]: gonna start on and actually we initially start with ten minutes uh for each side. Okay. So I'll open the public hearing I'll start at my particular left. Anybody in the left section that have some p positive comments, positive comments uh for this particular uh particular development, positive comments for this particular development on the left side. [0:58:05, 0:58:08]: My let's say in the middle. Anybody have any positive comments? [0:58:08, 0:58:11]: For this for this particular development in this middle section. [0:58:12, 0:58:18]: I'm going over to my right. Anybody on the right side? Posit comments on the right side for this particular development. [0:58:19, 0:58:31]: Okay. Mayor Ford. Yes ma'am just for the rec I have received a request to read a um public hearing comment from someone who is no it's supposed that is not present. [0:58:32, 0:58:52]: Okay. Well w I guess if that's time permits. Yeah we'll yeah we'll we'll we'll get to that point. Okay, thank you. All right. So now with any any comments that are in a sense not in favor. And the left side. On the left side. Now what I on the left side if you want. So please stand please line up on the left side, right there right strip. So anybody else [0:58:52, 0:59:12]: Else that has negative comments or comments against this particular proposal, line up behind this lady here. All right. Line up behind her. All right, so we can get in line here, find out what's going on. Anyone else on the left side? Alright. Anybody in the middle for comments against this particular proposal? Please line up behind the ladies over here. Anybody in the middle? Any com uh negative comments, comments that they don't want this? [0:59:12, 0:59:14]: [3554.3, 3554.8]: All right. [0:59:15, 0:59:21]: My far right, anybody in far right? Any comments against this particular proposal? Please line up. Okay. [0:59:22, 0:59:29]: All right. I see only two individuals at this point. Ma'am, you can come to the podium, come to Mike. Speaking of Mike, give your name and address, please. [0:59:32, 0:59:43]: Connie Snow, 426, Chase Mary and Way, McDonough, Georgia, 30253. I live in Eagles Crest subdivision, which is right next to where this proposed development is. [0:59:43, 0:59:51]: Currently you guys are seeing if I if I'm correct, if I heard this correctly, five feet spacing from property lines or less than ten feet. [0:59:51, 0:59:52]: Something to that effect. [0:59:53, 0:59:58]: I don't know about you guys, but that's pretty close to our property lines. We need at least twenty feet or more. [0:59:59, 1:00:17]: In addition, we need a barrier wall that is eight feet or higher to protect our property. I don't know about the rest of you, but those that are bordering that land where you're going to annihilate it and rip the trees or anything that gives them any security or protection, giving them that limited. [1:00:18, 1:00:29]: property line away from them is going to allow people to enter their backyard with ease. In addition, we want gates added to our neighborhood if you're gonna add this development. [1:00:29, 1:00:34]: We feel unsafe as it is. It is going to increase crime, despite what you say. [1:00:34, 1:00:52]: It is. We need the roads to be improved before those developments here. The roads can nowhere near sustain any of these developments. In regards to the development that's being built on Patrick Henry by Henry County, correct me if I'm wrong, that is a senior uh senior living complex. [1:00:53, 1:00:57]: For fifty five and older, we are all okay with that. We really are. [1:00:57, 1:01:17]: What are we going to do about the schools and the influx of the students? Has anybody addressed this with the schools at all? Because they're going to get impacted heavily. Our kids are already suffering in these schools. The buses are short, the teachers are short staffed, the kids are suffering. Have any of these things been addressed? Have you addressed the increase of police and emergency? [1:01:17, 1:01:25]: Services that are needed. More importantly, if you don't widen that road, how are you going to get ambulances and fire trucks down there to help people when they need them? [1:01:26, 1:01:46]: You guys are making a really bad decision. In regards to annexation, I'm totally against it. I'm against the rezoning. I feel like you're going to rezone it so you can qualify for PUD, so you don't have to have the public hearings on the variances, so that you can cut out our commentary and our comments and our wants. It seems to be happening a lot here. It really does. [1:01:46, 1:01:52]: I get that you guys have a vision for the city and the county, but it's not our vision. [1:01:52, 1:01:53]: It is not. [1:01:54, 1:02:00]: There are tons of people who say it. It is y'all's vision. And your vision does not align with what we want. [1:02:01, 1:02:04]: Thank you for your comments, ma'am. Please name and address. [1:02:08, 1:02:10]: Hi, I'm Tasha Kemple. [1:02:10, 1:02:14]: I reside at four ten Chase Marion Way, McDonough, Georgia, three oh two five three. [1:02:15, 1:02:22]: Everything that Miss Connie Snow has stated, I agree with her. Um I don't agree with this. [1:02:22, 1:02:23]: Um [1:02:23, 1:02:40]: I was listening to the attorney and she stated something regarding grilling in your backyard with that little yard. I own apartments, so I know that the law states that you have to have a grill within so many feet from a building structure. [1:02:40, 1:02:47]: So therefore, I think that's something to look into because that's like really close. So if something catches on fire, the whole place is gone. [1:02:48, 1:02:49]: Um [1:02:49, 1:02:51]: I have reviews here from the [1:02:52, 1:02:55]: A villa apartment in Texas. [1:02:55, 1:02:58]: Um please get somebody out here to fix the problem. [1:02:59, 1:03:06]: There's other comments here that just they're negative and then there's a C rating for that area for um the crime. [1:03:07, 1:03:10]: Um, I'm just not aga I'm just not for this, so um [1:03:11, 1:03:16]: I think there should be some fencing if this development comes through, um, eight feet at least. [1:03:17, 1:03:18]: Around the whole duplex. [1:03:19, 1:03:22]: That's enough to keep them from coming into our neighborhood. [1:03:23, 1:03:26]: Um, yeah, I agree that they need to have a gate, which they do. [1:03:27, 1:03:28]: Um [1:03:28, 1:03:34]: I don't know if y'all are aware of this, but there is a natural spring on that property. [1:03:34, 1:03:36]: I don't know if they've checked it out. [1:03:36, 1:03:44]: I know that he said he had researched and did his thing. There is a spring. I have a spring that goes behind my house. [1:03:44, 1:03:50]: So it flows right behind there. So I don't know, it looks like it might be a flood zone area to me. [1:03:51, 1:03:53]: Just my opinion. Um [1:03:56, 1:03:58]: What are we gonna do about the traffic? [1:03:58, 1:04:03]: 'Cause getting out of my neighborhood is already a nightmare trying to get on the Patrick Henry. [1:04:04, 1:04:12]: Dealerships, more buildings. How am I gonna get out? Are we gonna have a roundabout, a light? What's gonna happen to fix this problem? [1:04:13, 1:04:17]: Um, that would be all for today, but thank y'all for taking time to listen to me. [1:04:17, 1:04:22]: Thank you. Um, Mr. Ryan and um Miss Battle, could you come back to the podium please? [1:04:25, 1:04:32]: Before did you want to Oh, I'm sorry. Yes, I'm sorry. Yeah, I forgot about that. Thank you very much. Go ahead and read that in the a record. I'm sorry about that. [1:04:32, 1:04:39]: From Miss Ann Fields, three two nine Chase, Marion Way, McDonough, Henry County. [1:04:40, 1:04:52]: The developer provided incorrect documentation, misleading the public and especially impacting the wrong direction. Uh won't you come to the mic up here, please? So we can all hear you, make sure we got you on on tape. [1:05:00, 1:05:02]: Yes, Mayor Council. This is from um [1:05:03, 1:05:05]: and fields. [1:05:05, 1:05:13]: The developer provided incorrect documentation, misleading the public and especially impacted homeowners in the wrong direction. [1:05:13, 1:05:15]: Traffic study [1:05:15, 1:05:35]: Very news specific, too much heavier traffic flows from bridges at Jodico and the stores and apartments there. And environmental studies were not provided for review prior to the public hearings. More concerning when does the public hear and see the traffic and environmental studies? Is it once something is [1:05:35, 1:05:55]: Approved. It is critical that more public input and developer meetings take place prior to the council approvals. More public meetings for these proposed developers and constituents was a verbal statement made from the chair of the Planning Commission at the September meeting. I believe this was ASCII Abdullah. There is [1:05:55, 1:06:15]: Is a stream out of the at the location of the retention pond, environmental study and appropriate review of the government agency, Army Corps of Engineers. Shouldn't the stream be looked at prior to the approvals? There absolutely should be no dumpsters anywhere along the properties of Chase Marion Wade. [1:06:15, 1:06:35]: Especially the one in the plan rendering. And that is my very own backyard, and I paid a large premium for this home. It will be it will devalue my property. There needs to be a 20-foot buffer between the buildings. If 10 feet disallow apartment grilling and other fire hazards, the wish [1:06:34, 1:06:40]: of the county in in their ordinance twenty three-eight seem to have a higher standard [1:06:41, 1:06:45]: were designed for life safety and uniformity in the entire community. [1:06:45, 1:06:49]: Commun county adaptate adaptation should be considered. [1:06:49, 1:07:09]: Better line of sight on this property for police protection of the development and overall resident safety. Rear exit for ambulance, especially fire safety maneuvering. Road rendering clearly is not two full wide lanes. It's enough to maneuver cars in and out of parking spaces. [1:07:09, 1:07:29]: but not maneuver and turn a fire truck around safely in the rear of the plan. I am speaking as a CDL licensed professional driver. Setbacks with the Henry County Overlay Program should be respected to Stockbridge. There should be consistency by the Henry County Overlay [1:07:29, 1:07:49]: Overlay for appearance, attractiveness, and consistency. Our county standards are minimum 60 feet from the right-of-way line, 15 feet sides, 20 foot rear, pursuant to RM Multifamily Residence, Section 2.0202G, multifamily and cluster homes. [1:07:49, 1:08:04]: Twenty foot setback is crowded and unattractive. A banner wall no less than eight foot be enacted to protect the existing homes from the crime and noise. A barrier is a must. [1:08:05, 1:08:25]: It if complete deforestation to our Chase Marion property line is taking place, it will indeed result in root damage and root shallow and canopy heavy pine and create an imminent hazard of tree collapse to the remaining trees, which relied on the forest. [1:08:25, 1:08:45]: To stabilize the grouping. Residents should be allowed to work with the developer to clear any trees of ours at a very reduced price. Example:$10 per tree, less than five diameter trunk,$50 per tree, anything larger. Eagle's Crest is requesting the developer create a gated. [1:08:44, 1:08:54]: community entrance for Eagles Crest to further protect the residents here. At that point, resident homeowners can create a small HOA with the intention of maintaining [1:08:55, 1:09:02]: these gates. We are organizing to work with Henry County on a neighborhood watch program in the immediate immediate future. [1:09:03, 1:09:23]: The homeowners along Marion Chase desire insurance coverage on their property supplied by the developer to protect against tree fall, water runoff, and damage of the property from the tampering vibrations. What is the street lighting and landscaping plans as well as within the development itself? I found that. [1:09:23, 1:09:35]: Fail start bridges recommendations to developers to file a PUD are m misleading as that is too is a tool and the zoning aids and to avoid necessary discussion. [1:09:36, 1:09:37]: Thank you, Ms. Holy, appreciate it. [1:09:38, 1:09:41]: And uh now Ryan and Miss Battle, could you come back to the podium please? [1:09:48, 1:10:08]: I will see if we can answer some of these particular questions. I was I'm I'm assuming that you took some notes. I was taking a few notes here as well. So let's uh see if we can answer a few of these questions here. Um this property line issue and reference to the set uh the property line from the properties community to the the Eagles Crest community, and what's what's the what's the distance, the actual distance? [1:10:08, 1:10:16]: There. There's a 25 foot buffer requirement between the two different zoning designations. [1:10:17, 1:10:21]: Okay. Hold on a second. Make sure we're right on this. Hold on. [1:10:21, 1:10:21]: Mm. [1:10:24, 1:10:25]: It's twenty five eight. [1:10:26, 1:10:32]: To R M? Yeah I mean R M. [1:10:33, 1:10:50]: What kind of buffet feature on that? From their back to that? The ten foot um buffer because I don't think there was a requirement for a buffer between the because they're zoned for multifamily. [1:10:56, 1:11:16]: What you he's addressing that issue. Um our understanding is that the buffer requirement is in fact 10 feet. Um from the rear of the actual unit to the property line is probably about 20 feet. Um what you have behind there is the green space that is enclosed. So there's fencing there. [1:11:16, 1:11:36]: There, we will also have an eight-foot fence along the perimeter of the entire site, except on the side where the rehab facility is located, we'd like to drop it to six. If we want it eight around the entire thing, that's fine. But along the residential portion, which we can show here, everything adjacent to Chase. [1:11:36, 1:11:38]: Marion would be eight feet in height. [1:11:39, 1:11:44]: Okay. All right. So Mayor, I'm sorry. I I'm just a little confused. [1:11:44, 1:11:58]: Can you repeat that again? What's the total amount from from the but from the from the rear from the rear to to the from the rear of the house to the to the property line is about twenty feet. About twenty feet. Okay. That's what I really wanted. Yes, twenty feet. [1:11:59, 1:12:19]: All right, now the um okay, obviously it's a gated community and you mentioned and we'll have a fence around the entire parade. So not just the gate at the front. Right. Excuse me, I'm sorry. And but you also mentioned you've already relocated the dumpsters to a different from the original plan we relo relocated the dumpsters. So the dumpsters are not in any type of um I guess any type of violation. [1:12:18, 1:12:22]: [4350.0, 4350.3]: Mm-hmm. [1:12:30, 1:12:50]: On where they have it depicted at they have a large berm on that side that's like very hilly. So the six foot fence will be on top of the hill'cause they have like a large elevation on encompass on that side that that'll be facing encompass. That [1:12:50, 1:13:10]: That appeared that's where the dumpsters are gonna be, correct? With the new rendition, Miss Battle. Correct. They're gonna be on the opposite side. On the encompassed side, there's an elevation change of about maybe about twenty-five or thirty feet. So the feet, the fence would be at the top on that side. So six feet would seem appropriate because it's at the top of it like a thirty [1:13:10, 1:13:12]: Yeah. On that side. [1:13:14, 1:13:33]: So that'll be like a thirty-six feet. And I would think that any thirty-six feet buffer, basically. Right. Between from one to the next. Right. Okay. Because in cover sits down like this and then you got to go up a hill in order to get to this. [1:13:35, 1:13:36]: All the same. [1:13:40, 1:13:40]: Okay. [1:13:41, 1:13:43]: So you want to be able to [1:13:44, 1:13:50]: not being able to interpret that right here because I don't know what T means'cause it says only just [1:13:50, 1:13:50]: Support. [1:13:54, 1:13:56]: All of the situations. [1:14:00, 1:14:14]: But these are these are indicating office, institutional, commercial, industrial. Here's the multifamily one right here, and that's R S R. This is yeah, but this is the adjacent district, is R R S R. [1:14:15, 1:14:17]: Basic district is already on device. [1:14:19, 1:14:23]: Why would that be twenty-five feet if it's not just one feeder because we are possible family development? [1:14:24, 1:14:26]: So we're under this category. [1:14:29, 1:14:30]: All right. [1:14:31, 1:14:35]: So that means adjacent w district R if it's not an argument then that would have enough. [1:14:37, 1:14:43]: I wouldn't fall into that category. Why would I automatically fall when I've got a category safe? [1:14:44, 1:15:04]: All right. So um we we have the at least uh thus far the the separation from the proper line from the fence of proper line solved now? So I think that staff and I have a differing of opinion with regards to the width of the buffer. [1:15:04, 1:15:24]: It is agreed that we will address that issue during LDP or during land development. But our understanding, because the property adjacent to us in the county is zoned RM, which is actually an apartment designation, it's it allows for a higher intensity in Henry on the [1:15:23, 1:15:43]: Henry County side, along with I think their land use designation as well, that we are under no obligation for the 25 feet because what's adjacent to it says RR or SR, which is single-family residential, or RR as a zoning district, which are zoning districts. So that's how we enter. [1:15:43, 1:16:03]: interpreted it, but we will have to go back and address that particular issue because that would significantly impact that side of the site because we would have to adjust some units, maybe even lose some units on that side. So we've got to make I'll have to ask my client if they want to hold quite honestly or continue to proceed. [1:16:03, 1:16:05]: This evening on that particular issue. [1:16:06, 1:16:25]: Yeah, clearly said a question. You had you had uh you already clarified that, right? What? About the distance between the back the property the back from the back of the of the house, of the the unit of the property of back of the unit to the let me let me it's crest. Yeah, it's easier to show it on the on the site page. You said it was about twenty feet. [1:16:26, 1:16:40]: Okay. So I just wanna make it clear'cause I don't want there to be any confusion about what I was trying to say. Is there and there wait before you do that, there's a green space at there's like a you the property has a a [1:16:41, 1:16:46]: gate of in a fence and then there's s green space. Correct. [1:16:47, 1:16:55]: And then what's and then the back of the house. Right. And so what we're saying is that there's roughly twenty feet [1:16:55, 1:16:57]: Between if this is the fence [1:16:58, 1:17:01]: And this is where the back of the house is. There's roughly twenty feet. [1:17:02, 1:17:19]: Between the back of the house and the fence. Back of which house? The back of the of the units that we're building. Of the units. The back of our units. And then back there is where their backyard is with their with their fencing. Okay. And then beyond that will be the fence that will be put up for [1:17:20, 1:17:37]: The a around the entire primary fence around the entire back of the project. Okay. So there are two fences for your community. One for the property and then one again for to to mark the boundaries. Rounded line between the buffer. Okay. All right. [1:17:42, 1:17:46]: I just wanna make sure. All right. Well I have a few more here for [1:17:47, 1:17:51]: So you probably don't know what to do. [1:17:52, 1:17:53]: That's only roughly about twenty feet. [1:17:58, 1:18:00]: It doesn't have to be worked out now. [1:18:00, 1:18:01]: Yeah. [1:18:02, 1:18:04]: But if I get it rezo I gotta get [1:18:06, 1:18:07]: It does like a good person. [1:18:08, 1:18:09]: Tem feet. [1:18:12, 1:18:29]: Okay. We're gonna have to resolve this particular issue with regards to the twenty five feet because if staff is indicating that the buffer is in fact twenty five feet when it was our understanding that was only ten feet, that's a significant change. And so we would have to ask for this to be deferred to next month. I wouldn't have any choice. [1:18:31, 1:18:48]: All right, further more questions here. You mentioned about the grill. The grill is is in some type of we're just saying that no, it's not a built in grill. We're just saying people would have the ability if they wanted to have a little barbecue grill or whatever, like you do in in in the back of your own home. Okay. Okay. But it's not a a installed grill. [1:18:48, 1:19:08]: Okay. All right. I gotcha. I got you understand that. Okay. In reference to um uh well anything I if I understand correctly, state law uh doesn't allow you to utilize the uh potential overcrowding of schools or of uh the expansion of any type of roads as a decision making factor. [1:19:08, 1:19:28]: for communities such as this. Now the the school system of course as well as the city along the county would have to and go ahead through the process to try to improve roads as we need to improve them. But it's it's I believe it's not a it's they can't use this as a those two things as a as a denial per se. [1:19:28, 1:19:39]: by the state law is my understanding. And of course if that's not right we have an attorney here and a city manager here to straighten me out if that's the case. Um and I would think that any improvements that [1:19:39, 1:19:49]: they wanna make in the community, Eagles Crest community says is inside the county and not with inside the city, I would think that those improvements would have to be negotiated with the county. [1:19:49, 1:20:09]: That correctly. Right. Well, the county and and the county, I I I can just tell you, having worked for counties, they're not gonna come in and put in a gate and do other things of that nature. If the community wants to, because it also impacts their roads, so that means that all their streets now become private streets, which means that they would have to take over the operation of the maintenance and comp and uh repair of those streets. [1:20:09, 1:20:29]: And they would have to put up their own gate and they would have to maintain that gate. It is not as simple as saying, hey, somebody just go, you know, put up the gate. It has a lot of implications. So and that would be beyond the scope of this board to be able to do because that community is in unincorporated Henry County. Understand. Let me ask you a question. Let me ask a question. [1:20:29, 1:20:49]: Go ahead. Go ahead. So Ms. Let's try to understand where we are now and what the disagreement is. Coming back would not be advisable. So our our understanding and our um engineer and the process that we have gone through and our review of the code was that [1:20:49, 1:21:09]: That we proposed a 10-foot buffer along the perimeter of the site. What staff is indicating he can he can set forth, but our interpretation was that the property adjacent is RM, which is it says the adjacent zoning district. [1:21:09, 1:21:29]: In section 4.6.3 of your code. And it makes reference to manufactured home parks, duplex developments, or multifamily development. And it says if those are next to something zoned RR or SR, then it's a 25-foot buffer. And we're and they're not zoned. [1:21:29, 1:21:40]: zoned R R or S R. So from our perspective, we're not we are not subject to that. He then said that but there has another section that says all other [1:21:41, 1:22:01]: All other situations is twenty five and I'm like that we our situation is defined. So just putting us into the category of all other situations does not appear, in my opinion, to be applicable. So that would mean that everybody everywhere would have to do twenty five feet. I don't think that that's what was intended in the code. Okay. [1:22:01, 1:22:03]: Well let me just say this too, if I could. [1:22:04, 1:22:24]: Well go ahead. Certainly that's not what's been not what that's not what's uh being uh addressed over at Winding Creek and the Magnolia subdivision. There's there's there's a fence there and then there's a single family home right behind the fence. It's not 25 feet. So that's not what they did with the winding creek. [1:22:24, 1:22:34]: Winding Creek townhomes that are existing and then the Magnolia subdivision right behind it. We had to go back and ask them to install a fence because there wasn't even a fence there at that point. [1:22:35, 1:22:47]: I'm aware of those situations, yeah. Um go right ahead. So I'm looking at the properties and it's R M, R R, properties to the north are R M, properties to the south are R R. [1:22:48, 1:22:56]: Properties to property I'm sorry, R M and R A for to the north. Property in the case. R R and C three to the south. [1:22:56, 1:22:57]: Hold on. [1:22:57, 1:23:05]: R M to the east and R R O I to the West. Is that correct? [1:23:07, 1:23:13]: Sorry, I'm trying to go back. That's on page two. Yeah, yeah, they didn't put up the staff report. [1:23:18, 1:23:20]: 'Cause we're looking at Wizard's time for that. [1:23:20, 1:23:25]: And I have another question. We keep talking about these residents as if [1:23:31, 1:23:31]: Um [1:23:37, 1:23:40]: As you know, uh [1:23:42, 1:23:44]: Uh there is an issue. [1:23:45, 1:23:59]: with other communities and and constituents getting to know each other as if something's going to be someone's gonna be in danger um from one community to the next. It's kind of offensive. [1:24:00, 1:24:01]: To me. [1:24:02, 1:24:05]: Um I I I um [1:24:07, 1:24:17]: As a single mother, as an attorney, as a as a a a a syndicate a woman who went through a divorce and needed a place to stay and needed to rent. [1:24:17, 1:24:21]: And still had a a fairly great income. [1:24:21, 1:24:27]: This would have been perfect for me at that time, but instead I was homeless and had to rely on a neighbor. [1:24:29, 1:24:30]: And I'm okay. [1:24:31, 1:24:33]: So you know, people are human. [1:24:33, 1:24:53]: There are teachers, educators, officers, people that need housing. These are single family dwellings that are ranch style that senior citizens, seniors would love to have. They will go. These are homes. These are are not apart apartment complexes. The county had zoned some of these places a a high density. [1:24:53, 1:24:53]: Yeah. [1:24:55, 1:24:58]: But these are single family homes and dwellings and [1:24:58, 1:25:02]: No offense to anyone, but I want, I hope, if you hear me. [1:25:03, 1:25:05]: Loud and clear. [1:25:06, 1:25:11]: You know, eighteen hundred dollars for one bedroom is not cheap. [1:25:12, 1:25:21]: Two twenty two hundred dollars for a two-bedroom is not cheap, and twenty-five hundred dollars for a three-bedroom is not cheap. [1:25:22, 1:25:36]: Imagine the type of people that will live in those type of homes, young urban professionals or seniors who want ranch style homes. These are single family homes, they're not apartment complexes. [1:25:37, 1:25:40]: And I want us to stop. [1:25:40, 1:25:44]: Um, you know, I I hope that we stop judging other people. [1:25:45, 1:25:52]: before you get to know them or know who they are. Because the terms they, them [1:25:53, 1:25:58]: Be like Clayton County, Uff, someone had to remove trees to build your home. [1:25:59, 1:26:13]: And as a God fearing woman, as a mother of two girls who had to go through a divorce and live on my own and try to make it after a really bad car accident, this would have been perfect for me. [1:26:14, 1:26:16]: So them and they would have been me. [1:26:17, 1:26:18]: You're a councilwoman. [1:26:20, 1:26:21]: And I just hope. [1:26:22, 1:26:24]: That you guys consider that in the future. [1:26:27, 1:26:31]: As a whole, as an embodied you know, we we've got to do better. [1:26:32, 1:26:34]: Because people have to have a place to live. [1:26:35, 1:26:37]: And yes, you're right, we need to plan. [1:26:37, 1:26:42]: We need to plan for infrastructure. We are so there with you. We do need to plan for roads. [1:26:43, 1:26:47]: We but people are here and we need places, we need housing. We [1:26:48, 1:26:55]: Are working and we're trying to do what we think is in the best interest of Sotbridge. [1:26:57, 1:27:10]: That doesn't mean I've made up my mind. I wanna make sure that we uh you know, based off of what m Mr. Uh Ryan states, if he says that the city recommends a twenty five foot buffer and we need to, you know [1:27:10, 1:27:17]: go back and and you guys have a you know come back, that's that's fine. We figured it out. Okay. But what I'm saying to you is [1:27:18, 1:27:21]: Please in the future consider that. [1:27:21, 1:27:26]: Consider that we have officers and teachers and people'cause eighteen hundred dollars [1:27:28, 1:27:36]: We have subdivisions now. I don't know how much you pay in your mortgage, but you know, I don't want to pay for a one-bedroom house for$1,800. That's a lot of money. [1:27:39, 1:27:44]: So and for it to be maintained and well kept, I think that is um [1:27:45, 1:27:55]: And not to get off topic, but i I get a little in my you know, it kinda struck me the wrong way. And so I just want you to know that um we are one [1:27:57, 1:27:59]: Um, I don't want an eight foot wall. [1:28:00, 1:28:04]: As if someone's enclosed in some type of combined location. [1:28:05, 1:28:11]: I have no desire to do that. If you want a gate in your community, put one in it. But [1:28:12, 1:28:23]: This is a very nice establishment for mix you and in addition to that, but have mixed use developments. And we're growing and I'd rather grow in a quality smart growth. [1:28:25, 1:28:32]: than to grow and just throw up apartments everywhere or houses everywhere and then people are already parking on the sides of the street. [1:28:34, 1:28:40]: So please consider that. Consider what these uh the cost of this. It's not a a nine hundred dollar mortgage a month. [1:28:42, 1:28:46]: Thank you. [1:28:47, 1:29:03]: Uh the twenty five foot buffer doesn't apply in this case since the um the applicant is seeking a rezoning to PUD and PUD is concept based and what the council will vote is to accept their concept plan during this process. So if the council votes to accept it, then their plan is is sufficient. [1:29:03, 1:29:16]: Okay. Good deal. Mr. Black, go ahead, please. Well, I I was gonna uh hold off because you you pretty much answered uh half of it. Yes, sir. Uh for is when is separate and his P U D. Um [1:29:17, 1:29:31]: But when I think we're kinda we're near the buffer anyway, but it it's the way you're looking at the looking at it and f what it sounded like to me because when you talked about from the house to the gate to the gate to the next property, I mean [1:29:32, 1:29:39]: But when you talk about the house to the gate and then gate it and then you talk about the buffering between that gate it [1:29:39, 1:29:59]: Yeah. Um how do you get in it? I mean you can't get no more contained than that. Right. And and the other thing that um that um Mr. Andr Anderson and I discussed is that um those other properties are outside of the jurisdictional boundaries of the city, and so the code section actually applies to those properties that are within the city. So the [1:29:59, 1:30:11]: The the buffer that we are providing is the ten um foot buffer plus the green space area in between. Um so it does work out to be roughly about twenty, twenty five feet. All right, good deal. [1:30:12, 1:30:14]: Uh my question, Mayor, if you don't mind. Go ahead, sir. [1:30:15, 1:30:21]: management because of that buffer being if it's ten feet wide. [1:30:22, 1:30:29]: Maintaining that buffer where be maintained also. Property management company must maintain. [1:30:31, 1:30:34]: Okay. And they will maintain the fence as well. [1:30:34, 1:30:35]: Okay. [1:30:35, 1:30:55]: They are they are literally responsible not only for their fence, but even the fence that the homeowner, the um the renter will will have. They are responsible for everything. Everything belongs to the property owner, which and the property management company is representing the owner. So you're just renting. You don't get to put up your own fence, you don't get to put up [1:30:56, 1:31:12]: You know, your own grass or whatever, you get what they give you and then they take care and maintain it to make sure that it stays at a quality and standard that they represent. What last question, Mayor, if you if you would I'm just saying because I'm I I look at developments and then I look uh [1:31:12, 1:31:16]: Ten to twenty, twenty five years, thirty years down the line. [1:31:17, 1:31:24]: Um when you talk about home ownership and you talk about those covenants that are set for home ownership and we have management. [1:31:25, 1:31:30]: Uh the homeowners that themselves hold the management company accountable. [1:31:30, 1:31:36]: But when you're talking rental property, what accountability is gonna be held toward the management company? That's why I'm trying to make sure that [1:31:36, 1:31:56]: That that that the common areas are maintained and what what what accountability is bec how you h maintain countries. It's not like a regular homeowner where if you don't cut your graph a little bit, oh you know, whatever. [1:31:56, 1:32:16]: Around here, my assumption is that this city, as many cities and counties across the state have done, have put into effect policies and procedures on how they want their multifamily housing to be maintained. And you all have the right to enforce that these properties be maintained. [1:32:16, 1:32:34]: maintained well, they'd be up kept well. You have one point of contact, so you don't have to go, for example, in a situation where you're in a neighborhood and you've got multiple people that aren't doing what they're supposed to do. Now you gotta go to five or six different folks. No, you go to one party and you hold them accountable for whatever is happening within that community. [1:32:36, 1:32:38]: Okay. Um [1:32:39, 1:32:56]: It was mentioned about a flood zone. Anything along like Um that's not true. We've done our research with regards to that. Um also had a wetland study. There is a creek at the very top, um and we have to be outside of the the buffer there, but our engineer has made sure that we are in compliance. [1:32:56, 1:33:03]: Okay. And environmental studies is that uh Yeah, they've they've already conducted those and they found no. [1:33:03, 1:33:13]: All right. All right. Council, do you have any other questions for uh these two folks in front of us at this point? Mayor. I'm sorry. Miss Barber, you had a question? [1:33:14, 1:33:15]: Go ahead. [1:33:15, 1:33:16]: Um [1:33:17, 1:33:20]: What is the price point of these? [1:33:21, 1:33:35]: So the units, um the rental price will be one thousand eight hundred and fifty for a one bedroom, two thousand two hundred for a two-bedroom, two thousand five hundred for a three-bedroom. [1:33:37, 1:33:39]: Thank you. Um [1:33:41, 1:33:46]: The next thing, trees. And I know the comment that [1:33:47, 1:34:07]: Um the city clerk read mentioned about the trees and st stability of the trees once they're removed, all the other trees around it. So we've actually uh putting in a ten foot buffer, which means that we technically aren't supposed to remove anything from that area, or if we do, we have to go through the city arbors. [1:34:07, 1:34:22]: we will have to put in our tree plan and comply with whatever requirements are there in terms of um preservation. But within that 10 feet, we will be doing everything we can to save those trees within that 10 feet area. [1:34:22, 1:34:40]: And then when we put in the fence, the question will be whether staff will want us to put the fence on the inside or outside of that ten feet, depending upon if we're impacting any um tree roots along that that path. But that is something that developers and builders go through all the time and having to navigate that space. [1:34:41, 1:34:42]: Thank you. [1:34:44, 1:35:04]: Any other questions? Uh I just have a statement. Go ahead, sir. I I just want to say I want to thank you, Councilwoman Gantt, for making those statements. We we just have to get away from judging people and understanding that we know that these things are very emotional for a lot of folks, and these decisions are very tough. [1:35:03, 1:35:23]: For many of us, but we're following the city's comprehensive plan that we approved and we're moving forward with it. And I and I said this at the last zoning. See, my daughter rents here in Henry County. She couldn't afford a$350,000 house, so she needed someplace to stay. [1:35:24, 1:35:32]: These, it's not like uh we're running up there and we're just throwing up apartments right and left anywhere. We have found out that's what. [1:35:33, 1:35:50]: That is a needed product in the community. And certainly it's something that we don't judge everybody on. I'm certainly gonna not use these negative comments and and turse them toward my daughter or my son who both rent. And to understand that [1:35:50, 1:36:10]: People are people. And when we make these statements and we throw them out in public, that's how it comes at it. Because people are watching this. And I had somebody say online to me, I'm a renter. I'm not all bad. Why why are all these people downing me? Why are they saying that I'm gonna run down the community? I I I I've I've [1:36:10, 1:36:30]: I I don't know why they say that. Now certainly we trying to maintain the balance and we try to do that uh on a basis in each single family neighborhood that we do and everything to make sure that we make sure that that neighbor that single family neighborhood is maintained as mu mu uh owner occupied uh for the most. [1:36:29, 1:36:49]: Standpoint. But certainly there are going to be some rentals in these particular neighborhoods. And we just got to get away from judging people based on what they do. I know I rented. I don't know. I think almost everybody did. So at some point, we certainly want to make sure that we're treating people based on who they are, not necessarily. [1:36:49, 1:37:09]: Stereotyping them in this particular way. I certainly think that this development is an excellent development, quality development, and that we've done what we needed to do in order to move it forward. We're trying to grow as a city, and we want to make sure that we do that. These annexations are the way that we're doing that. [1:37:09, 1:37:15]: we grow and to move move forward. So based on that, uh with the conditions [1:37:16, 1:37:36]: Go ahead, go ahead. That have been specified by the staff, all of them being outlined, including uh adding the flock cameras to Okay, Mr. Thomas has some words that he needs to say. I'm sorry. I I did want to speak, uh I I believe you're getting ready to make a motion. Go ahead, go ahead. I'm sorry. Let me let me let me let me add mention this gentleman. [1:37:36, 1:37:44]: I have we have to have three separate votes now. It's not one vote. It's three separate votes, all right? So we gotta go through that three separate votes here. But go ahead, Mr. Thomas. [1:37:44, 1:37:48]: Well, I I I just really just wanted to reiterate and a and [1:37:49, 1:37:54]: things have sorta got very sensitive and and and and rightfully so. [1:37:54, 1:37:57]: And I know Mayor you sorta touched on that. [1:37:58, 1:38:05]: And and I think Mrs. Gantt and Councilman Alexander and and I think all of us ha sort of have reiterated [1:38:05, 1:38:09]: that these are not easy decisions. They're very sensitive. [1:38:09, 1:38:15]: And just listening to all of the comments, you know, we do understand. [1:38:15, 1:38:19]: about traffic. We get caught I get caught up in traffic. [1:38:20, 1:38:24]: With us having kids in the school, we understand the school issue. [1:38:24, 1:38:25]: But as was stated, the [1:38:26, 1:38:27]: The state [1:38:28, 1:38:30]: Do not allow us. [1:38:31, 1:38:32]: To use [1:38:33, 1:38:39]: those issues and making a decision. And and re reason why I'm emphasizing this because [1:38:39, 1:38:42]: Every development here in public hearing is [1:38:42, 1:38:47]: The same issues sort of come about traffic and about schools. [1:38:48, 1:38:49]: But I just want to say that [1:38:50, 1:38:53]: We can't use those issues. [1:38:54, 1:39:00]: in a decision that we make, we understand those issues truly. [1:39:00, 1:39:03]: But we cannot use those issues. [1:39:03, 1:39:06]: in making the decision. So we have to look at [1:39:07, 1:39:08]: The other [1:39:09, 1:39:21]: ingredients and other things in making these decisions. But they are not easy decisions, they are not rough um decisions, and we take in all consideration so [1:39:22, 1:39:25]: A lot has been said, so I don't have anything to add to the [1:39:25, 1:39:32]: overall discussion, but I just wanted to re-emphasize that to the point that we are sensitive. [1:39:33, 1:39:37]: to the needs of all citizens and where you live. [1:39:37, 1:39:57]: Because where I live, there are issues that I don't really agree with, even though I understand it, I don't agree with it, but we have to just continue to move on. So I just just wanna say we are sensitive to all of the issues when these issues come to us, and I just wanna say that. So mayor I yield back. [1:39:57, 1:40:17]: Problem. Okay, so I think there's all the comments at this point. So what we have three separate uh uh votes have to go here. So first one would be annexation case AX2023-03. Once again located Council District 5. Consideration of the request of annexation of property 77 and 87 Holloway Road with frontage on Parker Patrick Henry Park. [1:40:17, 1:40:23]: Parkway located in unincorporated Henry County into Stockbridge City limits. Is there a motion to accept that? [1:40:23, 1:40:24]: Uh so much. [1:40:24, 1:40:29]: So moved. Okay, is there a second? Second. Mr. Blount, second. All in favor, please indicate. [1:40:30, 1:40:37]: Un damage decision. Okay, vote number two. Comprehensive plan amendment case CP dash two zero two three-zero three. [1:40:37, 1:40:40]: Council District 5, consideration to request a comprehensive plan amendment. [1:40:41, 1:40:55]: to assign the future land use designation of high density residential to property seventy seven and eighty seven Holloway Road, frontage on Patrick Henry Parkway, located in unincorporated Henry County, and if and after parcels are annexed into the city limits of stopper. Is there a motion to accept that? [1:40:56, 1:41:05]: Yes, I want to ask you a question, Mr. And I want you to reiterate. This is consistent with the surrounding communities, Ryan. Yes, sir. Uh so move. Sir second. [1:41:06, 1:41:10]: I second. Miss Blount uh Gantt second then. All favor, please indicate. [1:41:11, 1:41:13]: Up opposed. [1:41:14, 1:41:17]: I don't know. I'm I'm looking and looking ahead. It's all favor? [1:41:17, 1:41:24]: Okay. Okay, all polls? Abstain. Abstain. 401. Okay. Uh [1:41:27, 1:41:47]: Okay, and also the rezoning case here, rezoning case RZ two zero two three-04 located once again Council District 5 to reassign to excuse me a request to reassign the zoning district, a PUD plan unit development to two parcels, 7787 Holloway Road, frontage on Patrick Henry, located on incorporated Henry. [1:41:47, 1:41:52]: County and yeah and and after the parcels are annexed in the city of limits to stop there. Please. [1:41:53, 1:42:13]: Uh we we got that change in there about the y yes, can you just uh add um with the conditions negotiated with staff between the door? Yes, uh motion to approve with the conditions uh uh negotiated with staff. And clerk, you miss uh holiday, you have down all the conditions, including the six foot interior. [1:42:13, 1:42:16]: All right, so move. [1:42:17, 1:42:18]: Okay, is there a second? [1:42:20, 1:42:25]: Is there a second? A second mayor, but I want to comment before. Okay, uh Mr. Blount second Dan and has additional comment. Go ahead, sir. [1:42:26, 1:42:32]: I just wanna say before we get off of this mayor, it it would behoove me to not say something. You know, when I moved to Henry County [1:42:33, 1:42:37]: Never thought I'd live here before in my life, but I love it here. [1:42:38, 1:42:40]: And one of the things that I've saw in Henry County is that [1:42:42, 1:42:44]: You almost had two sides. [1:42:44, 1:42:50]: Like a railroad track split into communities. And since I've been here, I've seen the community try to be split up. [1:42:51, 1:42:54]: But I see so much opportunity here in Henry County. [1:42:55, 1:43:00]: But one of the things about Henry County, I think that we should open it up and accept everybody because it's a time when [1:43:01, 1:43:12]: you yourselves before you got where you was going, some of us, that you wanted to l live somewhere, not that that was conducive that said, I gotta live over here'cause I'm a renter. [1:43:12, 1:43:14]: But I'm living over here because it's a good community. [1:43:15, 1:43:19]: That's the opportunity that I've d this development is giving people to live somewhere that's a good community. [1:43:20, 1:43:31]: And to think that we need ten foot fences and we need to make sure we keep them where they are, the renters, those bad renters where they are, is apostrous to me. [1:43:31, 1:43:35]: I was a renter myself, and I think I've always been a good person. [1:43:35, 1:43:38]: Whether I'm renting or whether I'm buying, I'm buying now. [1:43:39, 1:43:44]: So I think that to live in a good community, who wouldn't want that? Good schools, good areas. [1:43:44, 1:43:45]: You know? [1:43:46, 1:43:49]: I I think the deers are doing enough to find somewhere else to live. [1:43:50, 1:43:55]: So uh I'm that's why I'm I just wanted to say I'm for it because I think this is a uh awesome county. [1:43:55, 1:43:59]: And it's a awesome opportunity for those that want to live in a decent area. [1:44:00, 1:44:02]: And raise their children in decent school system. [1:44:03, 1:44:20]: And to be able to walk out the door and say, hey, I'm living here in Henry County amongst the ones that said, hey, they're gonna live here and they've invested here. That's all I gotta say. All right. So I just wanna clarify because the applicant made a request that staff agree with. [1:44:20, 1:44:23]: The combination section [1:44:23, 1:44:43]: Yes, we we agree. Okay. And then the eight foot Holloway Road. And then the flock cameras at both entrances. That's what was added. Yes. And then the re the uh the new um relocation uh staff needs to agree with the new site. [1:44:43, 1:44:45]: Yes, we agree. Thank you. [1:44:45, 1:44:52]: Thank you, Ms. Holliday. On that note, the motion was made in in second. All in favor of the motion, please indicate. All posed. [1:44:53, 1:44:57]: I'd stay. Okay, four zero one. Motion passed. Thank you, ladies and gentlemen. Appreciate it. [1:44:58, 1:45:13]: We'll move on to the next uh we'll close out this particular public hearing, this piece of this. We have two more to go. Next one is comprehensive plan amendment for KCP KCP-2023-04 and Council District 2. [1:45:13, 1:45:33]: Now this what I've been informed, this is consideration and request of comprehensive plan amendment to change the future land use designation of three parcels on Davison Parkway and Walfler Way, from low density vertical mix use to high density residential to allow for residential development. But I've been informed that we we don't have to do this because this was actually already approved. [1:45:33, 1:45:53]: By our comp plan that we recently approved, and so it's already in compliance. So this is this is a non-issue for us to vote to vote on this evening. But what we have to vote on would be the next issue that deals with rezoning case RZ 2023-05 in Council District 2. Consider once in once again, consideration of a request to rezone 3. [1:45:53, 1:46:05]: three parcels on Davison Parkway and walked away from C three heavy commercial to PUD Plan Unit Development to allow for a mixed residential development. Mr uh Ryan Anderson, please. [1:46:05, 1:46:15]: Thank you. Um before I begin I would like to say that this um this particular piece of property was originally part of the um the Rees Creek. [1:46:15, 1:46:35]: uh plan the original Reeves Creek one plan it was the portion that was set aside for um the commercial and the other um convention center and other type uses and the applicant is proposing to um build a c a residential development at this site. If you take a look at the slide [1:46:35, 1:46:37]: Slide on the film here, here's an aerial photo of the property. [1:46:42, 1:46:46]: This is area photo of the second property. It's it's actually three parcels. [1:46:49, 1:46:55]: And here's the aerial photo of the third parcel that fronts on Davison Parkway. [1:46:55, 1:46:57]: Here's a copy of the zoning map. [1:47:05, 1:47:07]: Here's a copy of future land use map. [1:47:10, 1:47:25]: The case facts. Uh the applicant is DR Horden, represented by Miss Tiffany Hogan. Like I previously mentioned it, the property consists of three parcels at Davison Parkway and Walterway, consisting of seventy-nine point one six acres. [1:47:26, 1:47:37]: You got one large parcel parcel that's fronts on Waterway and the small parcel also fronts on Waterway. And you have another small parcel consisting of one point three acres that front on Davidson Parkway. [1:47:40, 1:47:41]: Yeah. [1:47:42, 1:48:02]: The surrounding uses to the north you got vacant land, to the northwest you have uh Clayton County, to the south you got vacant land. And um it was a reason the vacant land to the south was recently approved for the um Rees Creek 2 project, consisting of over 1,300 homes, uh a large-scale PUD. [1:48:02, 1:48:22]: Southeast, you got the automobile refurbishing business called Drive Time. To the east, you got North Bridge Crossing 1 subdivision. And to the west, you got Interstate 675, 75, and 675. The existing property zone, the existing property zone C3, and the applicant is proposing to zone to go to PUD. [1:48:22, 1:48:36]: Surrounding zoning, to the north you got L I, R, and S R. To the south you got S R and D T. To the east you got DT and C1. And to the west you got suburban residential. [1:48:42, 1:49:00]: The large parcel has roughly three-fourths of a mile of frontage along Interstate 75 and 675. It contains Reek Creek near the eastern boundary of about ten acres of restricted use commercial and a lift station which is owned by the city of Stockbridge with an easement across Walterway. The property is mostly level and wooded. [1:49:04, 1:49:12]: The applicant is currently proposing to build 296 units, 168 single-family detached, and 128 townhomes. [1:49:13, 1:49:25]: The the current um land use designation is low density. Um and the applicant would have to combine the three parcels to form one parcel of land. [1:49:27, 1:49:47]: Zoning history. Um a portion of the subject property was rezoned in 2003 to RM for a condominium development. Um North Bridge Crossing DRI two eighty-four was approved for residential office and commercial uses. And uh development agreement for North Bridge Crossing was prepared in 2008. [1:49:47, 1:49:48]: and three and had four amendments. [1:49:50, 1:49:59]: Uh another rezoning was RZ 0912. It rezoned the property to C3 for commercial retail and office uses. [1:50:00, 1:50:04]: And like I previously mentioned, the property was part of the Rees Creek One D R I. [1:50:08, 1:50:12]: This is the original um Rees Creek site plan. [1:50:21, 1:50:39]: This is the LCI study that was done on behalf of the city back in 2012. And um it basically recommends that this particular property remains as um an activity center and remains as a commer remain as commercial uses. [1:50:41, 1:50:50]: Here's uh a rendering of what could be potentially located there by that was uh done on behalf of the LCI study. [1:50:54, 1:51:12]: The LCI study called for 1.5 million square feet of Class A office space, two full service hotels, 250 to 300,000 square feet of retail space adjacent to I-75, 750 to 1,000 units of high quality multifamily development. [1:51:14, 1:51:20]: three hundred and five hundred three hundred thousand and five hundred three hundred to five hundred units of senior housing or assistant living. [1:51:21, 1:51:28]: 1,500 housing units, um, twenty to twenty-five acres of that as a park and long-term parking decks alone. [1:51:28, 1:51:29]: I seventy five. [1:51:34, 1:51:48]: This is also another shot of the conceptual site plan that the applicant submitted on 12 8, 2023, a revised site plan where they removed um 15 uh residential units. [1:51:56, 1:52:16]: This was a um a conflicting case um on behalf of staff. We were kind of conflicted because anytime you get the opportunity to add uh single-family detached residential um uses to your uh city is is is considered a pretty good thing. However, this is one of the last few remaining large tracks. [1:52:16, 1:52:36]: Of land that's zoned commercial in the city, although it doesn't have ideal frontage. There have been several commercial development experts that say that the property will have a hard time being developed as commercial, and that what led to the applicant considering this proposal. [1:52:36, 1:52:56]: To develop uh residential uses on the lot. But back in um in July of of this year, when we had the Reeds Creek 2 hearing, um, staff that said that um it would try to protect this land as commercial due to the to the previously mentioned previous previously mentioned things that I stated. [1:52:56, 1:53:16]: Such as being one of the last few remaining tracts of commercial land left. And in the in the area, we have um approximate we have over 2,000 residential units planned and with little or no uh commercial. So Stockbridge, the city of Stockbridge has a average housing size. [1:53:16, 1:53:36]: Of 2.5 units, I mean 2.5 uh people uh persons per household. And if you time 2,000 by 2.5, that would give you well over 5,000 residents with no new commercial development to support all these um residential uses. So as a result of this results. [1:53:36, 1:53:56]: result of this staff recommend um denial of this application from um c three to um pu d based on that fact um however the the um the development is compatible with the existing neighborhood and um and [1:53:56, 1:54:16]: In the community, but we just feel at this time it's best to leave the property as as zoned as C3 to give um a commercial um development an opportunity to come on the scene. Uh we feel after all those planned um developments that we've already approved that will result [1:54:16, 1:54:35]: and over 2,000 new residential units. In due time, we feel that a commercial developer might get interested in the land and develop it as a commercial project. So that's the main reason behind staff recommending a recommendation of the Nile for this project. [1:54:36, 1:54:42]: All right, thank you for that, Mr. Ryan. Um um Miss Hogan, could you come forward please? [1:54:52, 1:55:02]: As a representative for um what is that, uh D R Horton, right? Yes, sir. All right. And uh what do you need to tell us this evening? [1:55:03, 1:55:04]: Let me get mine. [1:55:04, 1:55:06]: Let me get my presentation pulled up here, Mayor. [1:55:22, 1:55:28]: Good evening, Mayor and Council. Tiffany Hogan, Vice President of Fort Planning for D.R. Horton, Atlanta East Division. [1:55:30, 1:55:50]: Thank you so much. It's a pleasure to be here with you all again this evening. As you have heard, we are seeking rezoning of a property located at the corner of Walter Way and Davidson Parkway for a residential development. For purposes of this presentation, we are calling it North Bridge Crossing Phase 2. But after meeting with the [1:55:50, 1:56:00]: the community. Uh we agree with their desire not to name it Northbridge because of phase one. So I do want to specify that will not be the name of this project ultimately. [1:56:01, 1:56:07]: Uh also just to correct one thing before I get into my presentation, the um [1:56:07, 1:56:25]: Site plan that staff showed dated 12823 was actually still the old site plan. This site plan, and I'll show a better image of it here in a second, is actually the updated revised version that removes the 15 single family detached units from Walter Way. [1:56:27, 1:56:47]: Again, the location of the project, Walter Way and Davidson, directly across the street from Northbridge Crossing Phase One. In fact, the entrance from Walter Way is almost directly across the street from the amenities for Northbridge Phase One. We are seeking a comprehensive plan amendment. [1:56:47, 1:57:07]: Amendment this evening from low density vertical mixed use residential to high density residential. But I do want to point out the fact that with your recently adopted comprehensive plan, our plan would actually be within the low density residential because we are at 3.74 units. [1:57:07, 1:57:16]: We filed our application just about a month before you approve that we are being considered under the old standards according to your planning staff. [1:57:17, 1:57:37]: Stand by for a second, please. Yes. On that note. Well, uh I I my understanding is we don't have to vote on that tonight, so I just make sure is that correct? Uh we it's already it's already within a standard. So I mean you can brief it, but I don't think we have to do a formal action to a vote on that. And I need to get a legal opinion before we go any further to make sure uh a macro on this or whatever the case may be. [1:57:43, 1:57:54]: Yes, ma'am. It because we adopted the comp plan that was reviewed by DCA and by us, um, that that now the the density requirements actually comply if the council approves. [1:57:55, 1:57:57]: Um the rezoning. [1:57:57, 1:57:59]: It's already in compliance. [1:57:59, 1:58:04]: All right, just one clarification. Thank you. All right. Thank you, Mr Mayor. No problem. Go ahead, please. [1:58:06, 1:58:26]: So again, we're at uh 79 acres here on this site, uh 36.3 acres of open space. We have a creek that we are preserving on the space, and there are of course some local, state, and federal buffers around that. Uh so we are looking at preserving about 45.9% of the space on this site. One of the things that staff mentioned. [1:58:26, 1:58:46]: During his presentation, was the difficulty that commercial developers have seen with the site. One of those is that creek, and I will show that in the next slide. So, again, we have reduced the number of units on this site plan. Actually, this is the third reduction since our initial application. The last reduction was based on a second. [1:58:46, 1:59:06]: Second community meeting that we had last week. The first community meeting we had two folks that showed up that lived in the same residence. They were one of the existing homes that was built with Northbridge phase one. They had concerns about the buffer between their home and those 15 units that would be there along the front edge. During the second community meeting [1:59:06, 1:59:26]: Meeting last week, we heard similar concerns from the residents also about the access to Walter Way, and they would at they asked that we consider removing those 15 homes. So that is how we end up now with a unit count of 296 units, which is 128 townhomes and 120. [1:59:26, 1:59:29]: [7170.0, 7190.0]: And we'll skip that. And uh we are also seeking rezoning this evening or seeking rezoning this evening. The property, as you heard from staff, was rezoned to C3 in 2009, which is a high um heavy commercial usage. We are seeking to rezone to a PUD. We selected a PUD. [1:59:50, 2:00:10]: Rezoning simply because we wanted to be able to put a mixture of products into this development that could serve anywhere from the first-time home buyer to what we consider a move-up buyer by doing that with townhomes and single-family detached homes, which include ranch and two-story homes. [2:00:13, 2:00:33]: A bit more site data here. The townhomes are 24-foot wide townhomes, which are two um car garage townhome units. The single-family detached lots are 60-foot lots, and we are proposing a front setback of 20 feet and a rear setback of 20 feet as well. We wanted to add some additional parts. [2:00:33, 2:00:52]: parking here particularly for the townhome development. So there are 91 additional guest parking spaces on the site. Your code would require that we have 288 parking spaces. In total, we have 336 parking spaces for the entire development. [2:00:54, 2:01:14]: And again, here's that revised site plan, which removes the 15 units that were closest to Walter Way. As you can see very clearly, that creek runs the entirety of the property, which would cause um some impact for a commercial developer because they would have to determine how to handle that with separating the [2:01:14, 2:01:34]: Commercial commercial usage. While with the residential development, it can actually be an amenity to the site, particularly since we've removed those 15 units on Walter Way. We can actually now make that an open space or a park area that's along that creek area as well. So one of the other things that came out of the community meeting was they would [2:01:34, 2:01:54]: Would like for us to direct traffic from the Davidson Parkway entrance. So that would be the main access to the community. Um, that would hopefully alleviate some of the traffic with them entering their community off of Waterway. So we have agreed to place the main entrance monument off of Davidson in order to drive. [2:01:54, 2:02:14]: Traffic that way as the main access point. It is a full access in and out, and also Walter Way is a full access in and out as well, but will hopefully be the secondary entrance point. Some of that additional parking that I talked about is just as you come in the entrance from Davidson, the mail kiosk would be. [2:02:14, 2:02:34]: Be there for the town home side of the community as well. There's additional parking there throughout. I wish I could make this a little bit bigger for you, but hopefully you have it so that you can see it a little larger as well. So the Kelly Green homes are the townhome units. The more olive color units are the single-family detached units. The main [2:02:34, 2:02:46]: amenity area is that area that has kind of that red triangle there. There is a uh pool, a playground, pickleball courts, um, as well as a um [2:02:46, 2:02:56]: cabana for um with restrooms for the pool area. There are sidewalks on both sides of the street, interior for walkability throughout the entire community. [2:02:58, 2:03:18]: One of the other things that staff mentioned was further evaluation by commercial brokers. We uh because we heard the feedback uh from staff during this process, we did want to engage a consultant who is one of the number one uh commercial brokers in Atlanta, has been in the business for nearly 30 years, and he [2:03:18, 2:03:34]: his assessment of the property is that yes, while there is some frontage off of 75, because of the location and the lack of visibility and accessibility, it would be a difficult site for him to sell to one of his commercial tenants other than like a warehouse user. [2:03:36, 2:03:56]: Uh with this development we feel that it benefits the surrounding area in a few ways. Maintaining a family-friendly environment in an area that already has residential uses with families. One of the things that we heard during the community meetings was that they were extremely concerned already with the drive time being so near them and having that heavy truck. [2:03:56, 2:04:16]: traffic and that sort of thing coming through their community already. We could create a connection between Reeves Creek mixed use and the community of potential users. And there's no interest in year has been no interest in years for the existing site as a commercial development. Again, this was rezoned for commercial use in 2009. [2:04:16, 2:04:17]: Yeah. [2:04:17, 2:04:22]: There's no additional heavy truck traffic for the existing re residents with the residential development. [2:04:22, 2:04:38]: and topographic concerns for commercial development, including that creek that we talked about, and also on the side closest to the recently approved Rees Creek development, it is approximately a 30 foot drop-off on that side of the site. [2:04:39, 2:04:46]: This is just a lot typical of what the lots would look back w look like. I'm sorry, with those setbacks that we talked about. [2:04:46, 2:04:49]: That's for the townhouse and that's for the detached lots. [2:04:50, 2:04:54]: And then showing the zoning map here again, which you've seen a staff report. [2:04:56, 2:05:16]: We have proposed five additional conditions from the conditions that you see in the staff reports. So in addition, um d a lot of these came out of that community meeting. So we removed the 15 homes and we already did that, and it's on the site plan thus dated 12-7, 2023. [2:05:16, 2:05:36]: Select a name for the development that does not reference Northbridge in order to avoid any confusion with phase one. We will place the main entrance monument for the development at the Davidson entrance in order to encourage usage of this entrance as the main entrance, and a secondary entrance will be located off Walter Way. Both entrance [2:05:36, 2:05:46]: Entrances will remain as full access entrances. No more than 5% of the homes may be used as a rental property, and there shall be a mandatory homeowners association. [2:05:52, 2:06:12]: Just a few points about the community again, 296 total homes with that reduction. 128 of those are two-car garage town homes. 168 of them are single family detached homes. Those are also two-car units. There will be some ranch or one-story plans, and there will also be two-story plans. [2:06:12, 2:06:23]: All of the units will have three to five bedrooms throughout. That's for the single family detached. The townhomes will be three bedroom units with the exception of an option [2:06:23, 2:06:43]: For a four-bedroom unit in one of those units on the end of the building. Again, a mandatory homeowners association to assist with maintaining the community and the amenities, and the amenities to include a swimming pool, clubhouse, I believe I said cabana earlier, it is a clubhouse, multiple open spaces throughout that will be used as park spaces. [2:06:43, 2:06:46]: multi-use paths throughout and a playground. [2:06:47, 2:06:57]: And again, just to remind you all that uh we do have the Main Street Stars program that offers incentives for those local heroes that live among us. [2:06:58, 2:07:18]: And also the Home Buyers Club, which help helps people not just qualify for a home, but to become successful homeowners for years to come and help to create generational wealth. I do understand that one of the things that council is considering tonight is the fact that in 2012 you did have that little livable centers in [2:07:18, 2:07:38]: initiative completed. What we should consider with that is that since 2012, many things have changed in the community regarding your demographics even that are in the community. So while there was a plan there for some commercial usage here, we do believe that a residential usage is appropriate at this time. [2:07:38, 2:07:50]: At the end of the day, your jobs that are created do have to have a home to go to as well. So this would be adding additional homes that could be for home ownership to the community. [2:07:50, 2:08:10]: Um with the staff proposed conditions, the date of the site plan uh actually says 72723 in there. So it does need to be the 12723 date to reflect those 15 units being removed, and that was condition number three, and then condition number five was for a [2:08:10, 2:08:30]: Traffic impact study. That traffic impact study has already been completed and has been provided to staff as well as the councilman for this district. And I did fail to mention that the traffic engineer is also here with me this evening, Mr. Clay Smith. If there are any specific questions related to traffic, uh one of the [2:08:30, 2:08:50]: Other uh things that came up in the staff presentation regarded uh retail and accessibility for folks in the homes over there. Uh we have checked in that on Walmart, uh Aldi, all of those things in that area are 0.7 miles from this development, which would be less than three minutes for folks to get. [2:08:50, 2:09:10]: And that is a very high highly commercial area, as we all know. I am happy to entertain any questions from Council and Mayor. Thank you for your presentation, Tiffany. Mr. Thomas, sir. I know you probably have something to say. Thank you, Mrs. Hogan. [2:09:10, 2:09:27]: At several other meetings with some of the property owners, and we definitely want to thank you for um making those uh conditional changes. [2:09:27, 2:09:30]: But what I wanna s sort of mention to the council is that [2:09:31, 2:09:34]: This development is unlike [2:09:35, 2:09:37]: the previous [2:09:37, 2:09:40]: uh development that we just discussed because there's no [2:09:41, 2:09:43]: uh adjacent [2:09:44, 2:09:47]: community or neighborhood or anyone [2:09:48, 2:09:58]: that's opposing uh this development, it is sort of coming from within. And we have and I have met and Ms. Hope, we have met with [2:09:58, 2:10:01]: uh the property owners in that p particular area. [2:10:02, 2:10:04]: So it seems that it is [2:10:05, 2:10:07]: residential [2:10:07, 2:10:12]: versus commercial. And I know this is why [2:10:12, 2:10:13]: The staff [2:10:14, 2:10:16]: And the pl and the zoning board. [2:10:17, 2:10:19]: recommended denial because [2:10:19, 2:10:39]: As Mr. Anderson stated, that this particular uh these parcels were somewhat set aside for that commercial use. Uh and I'm sure once we get into the the public hearing phase of it, men of the the the citizen uh in that particular area probably [2:10:39, 2:10:42]: come forward and and mention that [2:10:42, 2:10:45]: But I will say thank you again for [2:10:45, 2:10:48]: uh those proposed changes because [2:10:48, 2:11:08]: In those meeting with the uh citizens, we talked about all of those issues. Uh, you know, the the uh egress, ingress, and you was willing to to change the focal point uh that you was also willing to remove those 15 units. [2:11:08, 2:11:14]: that was across from the the pool house right their own walkedway. So you did do all of those. [2:11:15, 2:11:16]: But my [2:11:16, 2:11:20]: My long term concern though is [2:11:20, 2:11:24]: this being one of the [2:11:25, 2:11:27]: Last properties. [2:11:28, 2:11:32]: for commercial. An and let me say here too that even the community [2:11:33, 2:11:36]: They really weren't sure if they wanted to see [2:11:37, 2:11:39]: Uh in additional [2:11:40, 2:11:42]: residential development there. [2:11:42, 2:11:44]: Or if they wanted to see commercial. [2:11:45, 2:11:55]: So it was one of those kind of a deals and I don't know if if really if they, you know, decided on which way to go with that, but [2:11:57, 2:11:59]: Thing that I'm thinking about is [2:11:59, 2:12:05]: Anytime you do have a commercial development [2:12:06, 2:12:09]: You do have a residual of [2:12:09, 2:12:13]: uh sales tax that would um [2:12:14, 2:12:15]: Impact. [2:12:15, 2:12:17]: The possibility of [2:12:18, 2:12:22]: the city raising taxes because it would somewhat [2:12:23, 2:12:43]: Uh offset or it would have some impact on that. And I think we have to take those things in consideration because as the residential areas grow in that particular area, and if you're familiar with that area, it is a lot of raw land. And so we know that something is coming, whether it's [2:12:43, 2:12:43]: The dental. [2:12:44, 2:12:45]: Or whether it's commercial. [2:12:46, 2:12:47]: It's coming. [2:12:48, 2:12:49]: And so [2:12:49, 2:12:53]: Those are some of my concerns and so even up to this moment. [2:12:54, 2:12:55]: I really didn't know [2:12:56, 2:13:04]: what recommendation I would make, even though I know that the the staff and the zoning board recommended denial. [2:13:04, 2:13:07]: So but I do understand both sides of that. [2:13:08, 2:13:28]: But I hopefully at the end of the night we all will have a better understanding. And I think, Mr. Anderson, you made a great uh presentation. And Mrs. Hogan, I think you did very well in articulating those conditions and those changes. So may I just gonna yield back and we'll sort of see how the public [2:13:28, 2:13:29]: [8009.5, 8011.7]: And I think for the council I know [2:13:31, 2:13:33]: Uh Mr. Garden. [2:13:35, 2:13:48]: Is he still? Yeah, question for the start. No, no, I I just know he came forward just a minute ago and said that it did meet uh all of our uh comprehensive plan and et cetera. So I don't know. [2:13:49, 2:13:50]: Um [2:13:52, 2:14:01]: What is the heavy decision for us to make here on this council? So we'll just go through the public hearing and and we'll we'll see from that. Mr. Alexander, go ahead please. [2:14:03, 2:14:05]: I thought you had your hand up. I do, okay. [2:14:06, 2:14:09]: Uh Ryan, come back to the podium. Please. [2:14:12, 2:14:32]: Now when we worked out the agreement for the flipping road project, we worked we worked out access through this area uh to get to David. We we reserved this area for future access to get to Davison Parkway so that we could get those trucks out of North Bridge. [2:14:32, 2:14:52]: Crossing that go through there every day. Now, they agreed at that point that they would provide access to us to the northernmost tip of their development so that when we when a commercial developer did come along to develop that new [2:14:52, 2:14:58]: northern section that they would provide that that could ac provide access. [2:14:59, 2:15:19]: to drive time to be able to get the trucks out of North Bridge Crossing and then they would be going through the commercial part that would be developing at that point. Is that is that that that that was the whole thinking behind what we were doing, right? Yes. B back in July, yes. Mm-hmm. Right. So if we did this development [2:15:18, 2:15:28]: with no commercial component, then basically we would never be able to get those trucks out of North Bridge Crossing, right? But out going through a residential area. [2:15:29, 2:15:30]: Yes. [2:15:30, 2:15:50]: And I think that that's where my biggest issue is, is because we we made some plans contingent upon what we were doing in order to get the trucks out of North Bridge Crossing through a commercial development. Now, since this project does not have any commercial attached to it, then it it kind of binds us and there's [2:15:50, 2:16:10]: There's no connection even to that into the flip and road project, right? There's no there's not even any connection to it. No. So basically we would be sealing the fate of those residents in North Bridge Crossing that they would those trucks would be coming through there forever, or basically at this point. I mean there would be no other option, right? [2:16:10, 2:16:10]: Right. [2:16:12, 2:16:32]: Not that I can think of, no, sir. And and that's what my my concern is when I first saw this, I thought maybe it was a mixed use development with some commercial, and that that commercial access would provide us some connection to uh the flipping project because we approved all of those residents or [2:16:32, 2:16:52]: Residential units over there because we wanted to reserve that commercial portion for future hotels, restaurants to serve all of that. And that was supposed to be the carrot that would attract someone in a commercial development to develop that parcel because all of those residential units were already. [2:16:51, 2:16:52]: Already there. [2:16:52, 2:16:57]: Yes, that's that's that what I that's what I think it was at the time. Yes. [2:16:58, 2:17:16]: And and and that's that's that's the real truth. I don't know whether there's some uh option where the we might be able to revisit this at a later date where we could add some res some uh commercial component to it,'cause basically as uh the councilman said, this would really be just adding [2:17:16, 2:17:36]: One dollar for every residence and one dollar in usage to what we're where we're trying to go. So basically we need something to help offset uh this particular development. And we try to and that's why we reserve this land to offset their what we had already uh kind of looked forward to, but certainly [2:17:36, 2:17:43]: There's some flexibility to see maybe at some well we might be able to revise the plan to include some um [2:17:45, 2:17:53]: commercial or to maintain the frontage uh for future hotels or something that will be along the I seventy five quarter. [2:17:54, 2:18:11]: You you know, I I I one second. I that was you a question for the applicant. Okay. I I got yes, she she can come forward. She can come forward, that's no problem. But I was just wondering, I thought that would be might be something we might should be able to work out, or hope, that we can still do this, but um and maybe that's what you're gonna try to answer here. [2:18:11, 2:18:13]: Uh but go ahead, please. [2:18:16, 2:18:36]: Good evening again. So, unfortunately, we are aware that some promises were made. The seller of this property was not a part of the Reeves Creek development. They are a separate seller. And I actually spoke with him again today to get some clarity on this very issue. [2:18:36, 2:18:48]: At the time that the Reeves Creek project went through, he was contacted to see if he would be willing to sell. However, we were already under contract for the property. Okay. So [2:18:50, 2:19:02]: Holding the seller of the property accountable for something that was said with a different project affects the rights to his property. And so that it would be the concern here. [2:19:02, 2:19:22]: Well certainly I I certainly concur with that, but the zoning in place already dictated commercial. That's what we have there today. We have a commercial zoning there right now. And you're asking us to change that commercial zoning to that particular property. So that's an issue. Is there any flexibility where you might be able to add some [2:19:22, 2:19:30]: for when a reg a mixed use development of some sort with this uh with the residential included. [2:19:30, 2:19:50]: Yes, sir. So as previously stated, there is an opinion that the seller received as well from a commercial broker, very likely the broker that he would use, that says that the site is not a good site for commercial usage. So his concern would be the value of his property. [2:19:50, 2:19:56]: property of course. And unfortunately D.R. Horton is not a commercial developer. We are a residential developer. [2:19:57, 2:20:17]: You see, if we listen to what people said about the South Side, we would never get any developments approved.'Cause certainly we we we don't listen to what these commercial brokers say. Otherwise we just forget it. Well, we just gotta keep going to the north side. Well we're not gonna continue to do that. So I certainly understand your position and [2:20:16, 2:20:26]: And uh again the property most assume that a commercial uh designation would be more valuable than a residential [2:20:26, 2:20:27]: Designation. But [2:20:28, 2:20:38]: I mean it really it's not just up to me, it's up to the rest of the council, but I have some concern about these residents who uh over there in North Bridge Crossing for sure. [2:20:39, 2:20:53]: And Mr. Mayor, may I clarify something? So it's not a north side, south side um analysis, uh Councilman Alexander. It has to do with the accessibility and visibility of the site is what the consultant based that on. [2:20:53, 2:21:05]: Oh thank you. Any other qu yeah, go ahead. Uh Mr. Blount I'll give Mr. Blount here. One of the things I've found and and you're probably correct in what you're hearing. [2:21:05, 2:21:10]: But what I'm hearing it is a north side, south side thing, even down to Whataburger. [2:21:10, 2:21:12]: They had several Whataburgers that was coming. [2:21:13, 2:21:14]: None was coming to the south side. [2:21:15, 2:21:18]: When you see these high end restaurants coming with the chains [2:21:19, 2:21:27]: None are coming to the South Side. And so it's gonna take elected bodies to change that perception of the South Side. [2:21:28, 2:21:35]: The elected bodies on what we accept or don't accept, not development, not developers that want to bring in homes. [2:21:36, 2:21:38]: I thank God for those developers that wanna be on here. [2:21:39, 2:21:44]: But the perception of the South Side is only gonna be changed by the elected bodies in the counties and the cities. [2:21:45, 2:21:46]: Because if we listen to [2:21:47, 2:21:49]: Your interest in building [2:21:49, 2:21:57]: versus we knowing what we can offer to these high end restaurants and these and and and and and entertainment venues. [2:21:58, 2:21:59]: It only changes here. [2:22:00, 2:22:04]: Because on the south side, they didn't think a successful amphitheater would be great. [2:22:05, 2:22:08]: And we're selling out. We got the top notch shows. [2:22:09, 2:22:14]: is because what the elective body did, not not listening to the developers. So I wanna disagree [2:22:15, 2:22:21]: respectfully that it takes a body of elected officials to change to make change, not developers. [2:22:21, 2:22:23]: Mr Thomas, go ahead, please, sir. [2:22:23, 2:22:27]: And also this property in question. [2:22:29, 2:22:30]: It was stated that it is [2:22:31, 2:22:33]: Офтемей пат. [2:22:34, 2:22:36]: Which I somewhat disagree with that as well. [2:22:37, 2:22:43]: And I almost sort of uh concur with the comments that Councilman Blount just made. Now [2:22:44, 2:22:56]: Daddy's a representative here tonight. I have not met. I only spoken with him on the phone. And he he represents a client that's looking to come and develop. [2:22:56, 2:23:01]: the other side of Davison and I know he is probably [2:23:02, 2:23:08]: watching and waiting to see what happens uh in this development. So [2:23:09, 2:23:10]: They are coming. [2:23:11, 2:23:12]: They are coming. [2:23:13, 2:23:14]: Um [2:23:14, 2:23:17]: He is also looking to bring in a [2:23:17, 2:23:20]: residential development as well. [2:23:20, 2:23:23]: And I pretty much said the same thing to him. [2:23:24, 2:23:24]: That [2:23:25, 2:23:26]: The city [2:23:27, 2:23:28]: It's somewhat [2:23:29, 2:23:40]: designating this property for commercial use because as Mr Anderson indicated that this is one of the last strongholds for that. [2:23:46, 2:23:46]: Right. [2:23:47, 2:23:49]: The present zoning. [2:23:50, 2:23:50]: And [2:23:51, 2:23:52]: What is allowed? [2:23:53, 2:23:54]: Commercially [2:23:55, 2:23:57]: uh in in the in the in the present zone. [2:23:58, 2:24:07]: Well, it's currently zone C three. Uh and what what's allowed in on C three is you got you can have automobile brokers, um [2:24:09, 2:24:10]: Well [2:24:11, 2:24:17]: But it's also an overlay district. So we'll the op the PMU overlay district will r would restrict a lot of these things, but you [2:24:18, 2:24:37]: You could have uh automobile service repair, building and lumber supply establishment, commercial parking garages and lot, commuter transit such as bus and train, department stores, farmers market, many warehouses and storage buildings without outdoor storage, office uses, retail, wholesale, [2:24:37, 2:24:50]: Including outside storage, recreational vehicle boat sales and service, trade shops, electrical plumbing, heating, cooling, roofing, siding, tattoo shops, used appliances. [2:24:50, 2:25:10]: With all due respect. The parkway corridor, doesn't that restrict all most kind of stuff you just said? Yeah. So no no no no uh let let's let's make sure everybody understand. Right. The parkway overlay ordinance will not allow t all most of what most of those yeah, most of those uses wouldn't be allowed. So we we really want to hear about the more attractive [2:25:10, 2:25:30]: So you can have hotels, restaurants, yeah, restaurants, I know retail shops and things of that nature. Hotels, restaurants, hotels, most retailers. Department stores, furniture stores, health services clinics, pet shops, once again restaurants. [2:25:30, 2:25:43]: Restaurant, retail warehouses, sporting fields and complexes. And um and also with a conditional use permit, you can have um well, funeral homes. [2:25:45, 2:25:50]: Well, Mr. Anderson, if if I may, I I I really don't wanna give anyone the impression [2:25:50, 2:25:54]: That metadata thing that you uh mentioning [2:25:55, 2:26:00]: would actually come to fruition. No, no sir. I mean it was [2:26:00, 2:26:05]: And and and I think this this s this council is more interested in [2:26:06, 2:26:10]: bringing in those other amenities and that and I think this is why [2:26:10, 2:26:12]: Correct me if I'm wrong. [2:26:12, 2:26:15]: The the zoning board and the staff [2:26:15, 2:26:18]: Recommended that this remain [2:26:18, 2:26:21]: uh commercial. So we could bring in [2:26:21, 2:26:25]: Uh those likable retail the the hotels [2:26:26, 2:26:27]: Quality hotels. [2:26:28, 2:26:39]: uh the restaurants, the retail and and those kind of those kind of entities. And I think this is what this council will be more amendable to as opposed to [2:26:40, 2:26:45]: Some of those other light industry things that you just mentioned. Yes. Um [2:26:45, 2:26:47]: So but could [2:26:47, 2:26:52]: Mr Alexander, you can continue. Uh Mayor I yield back. I see Mrs. Gate. Mr. Alexander, you have another comment? [2:26:54, 2:27:14]: I just wanted to say, you know, this is why we passed these parkway corridor or ordinances to make sure that nothing but excellence comes along those corridors. So I just wanted to make sure that that information was corrected on the record that those issues should not be allowed there. You can't even have gas station on the parkway. [2:27:14, 2:27:34]: Parkway corridor, is that correct? Yes, that's true. So so certainly there's a there's a lot of restrictions versus the tat no the tattoo shot would not be allowed there. So several of the others would not be allowed there. So the parkway ordinance demands that the to the the sidewalk be there, the upgraded landscaping, it prohibits truck stops and all that. [2:27:34, 2:27:46]: those unwanted stuff that we we would never want there. Thank you. All right, Ms. Gann, go ahead please. Um our LCI was updated from the twenty twelve and it states that um the City of Stockbridge. [2:27:47, 2:27:48]: Um [2:27:48, 2:27:52]: mm map contains growth centers and the subject property [2:27:52, 2:27:56]: shown as part of I seventy five Activity Center. [2:27:56, 2:28:16]: Further, an I-75 Activity Center concept plan was prepared showing the subject property as being part of a projected major employment center with mixed uses, such as uses such as and that are envisioned to include Class A office space, hotels, retail uses, high quality. [2:28:16, 2:28:25]: quality multifamily senior housing and park space. A new north-south roadway would be constructed through the subject property to connect with Flippin' Road. [2:28:25, 2:28:39]: with non-residential uses being located on the western side adjacent to I-75, I-675, and high quality multifamily and senior housing housing use uses being located on the eastern side. [2:28:40, 2:28:54]: That is something that I'm interested in. I'm interested in smart quality growth. These things are listed here. These are the things that we have talked about that we wanted. These are the things that we have envisioned for the city. [2:28:54, 2:28:55]: Um [2:28:56, 2:29:05]: It it seems like a lot of homes and it it seems like l a smaller lot and I I truly believe that because it's commercial and we have very uh [2:29:06, 2:29:11]: a limited amount of commercial land that we have here right now, zone commercial here in Stockbridge. [2:29:11, 2:29:13]: I think we should hold on to that. [2:29:14, 2:29:27]: And go after some of those developers. Well let some of those welcome some of those developers who want to build commercial on our property. Uh on the on this property, on that property, that zone commercial already. Um [2:29:28, 2:29:48]: And the reason being is we are are constantly building, we're growing. Um but when you look at the um the that particular area, there is commercial right up the street. You mean I mean you got your post office right there, you got other places maybe not as desirable as I wish. [2:29:48, 2:29:52]: Right? But there's a potential for [2:29:52, 2:30:12]: growth there in regards to smart growth with some some really nice retail, some maybe restaurants within that cluster envision. And the reason why that's possible is because people have already envisioned it. They've made proposals for it, even in unincorporated Henry. They've made proposals for it for Stockbridge. So I know that [2:30:12, 2:30:14]: [9015.0, 9017.1]: They the developers are interested in it. [2:30:17, 2:30:25]: And I I can't say that they wouldn't be interested in it being a part of a commercial piece. It look to me, it flows perfectly. [2:30:26, 2:30:45]: Uh the the applicant is um requesting uh deferral so she can work with her uh with their com commercial investment arm to see if they can create um a mixed use development. So she's asking for what what what council consider uh a deferral on the item tonight. [2:30:46, 2:30:48]: Well yeah, go ahead, Mr. Blount. [2:30:48, 2:31:08]: Um if she withdraw the application, she can bring it back in any time they want to. Yeah. But if she wants to go forward and it's denied, she has to wait a year. Yeah, that's what she is. That's why she said she was asking for uh a deferral so she can go back and work with their commercial peace. I'm amendable for her wanting to withdraw application and bring commercial peace if if the sub [2:31:08, 2:31:13]: Yeah, that's what I was saying. I was asking for that. Mr. Thomas, you got a comment on this? [2:31:15, 2:31:26]: Okay. Anybody anybody else have any comments on on potential deferral and be the course of that. All right. Yes, sir. Go ahead. [2:31:27, 2:31:28]: Yes, um. [2:31:29, 2:31:32]: Mrs Ms. Hogan, did you wanna say something before I make this motion? [2:31:33, 2:31:35]: No, sorry, we we [2:31:35, 2:31:55]: We are going to um we would request a deferral and there is actually a piece of property that we did not point out that remains commercial, is not a part of this deal. Um and with the 15 homes removed, maybe there's an opportunity there for a neighborhood community center uh neighborhood retail center. [2:31:55, 2:32:10]: center or something. So we would like the opportunity to uh take a look at that and that way it's not denied and it's a year before anybody could come back here. So h how long will it take you to actually to come back? [2:32:10, 2:32:18]: We will work with staff. You need forty-five days now for publication. Uh [2:32:19, 2:32:39]: February was that two months? February at the earliest commission councilman. Okay. Well Mayor Ford. Yes, sir. Actually. I I move that we defer this item for forty-five days to allow the developer to uh reconvene with the council with a new [2:32:39, 2:32:40]: New uh proposal. [2:32:41, 2:32:41]: Okay. [2:32:42, 2:33:00]: Uh is there a second of that motion? Um go ahead. It's actually February's gonna be more than forty five days. You might want to give it a date in f first meeting in uh February. That's gonna be more than forty five days. Okay, that's a good point. So it we have to have time to actually redesign the site plan in the end forty five days for publication. No. Maybe sixty days. [2:33:00, 2:33:20]: Well I mean uh if y well you gotta it w I I would prefer you to defer it to a d uh a council meeting, either first meeting or last meeting in February. That way they can uh know. March. Right. First meeting in March would actually work with the timeline. Okay, first okay. Well Mayor Ford, uh I am in my motion to indicate [2:33:20, 2:33:25]: uh the first meeting date uh in the month of March in twenty twenty four. [2:33:25, 2:33:28]: All right. I second. Okay, Mr. Blount second. I must all in favor, please indicate. [2:33:30, 2:33:36]: Thank you very much. Thank you, Miss Hogan. Appreciate it. Just many. And I I just want Miss Hogan real quick. [2:33:38, 2:33:56]: I I want you guys to um pay attention to w what the vision of the city of Stockbridge wants, not necessarily um oh we're just gonna put a activity center out. We we actually have a list of things that we uh we desire for that particular area. Thank you. [2:33:56, 2:33:57]: [9239.0, 9242.6]: Well happy holidays to you, Miss Hogan. We'll see you early next year. [2:34:03, 2:34:05]: Is it only small? [2:34:05, 2:34:25]: Okay, what we have next we'll end that particular public hearing and go on to the third one. And this deals with an annexation case AX3 excuse me AX two zero two three-04 Council District 5 consideration of request to for annexation of property 2250 and 20 [2:34:25, 2:34:26]: Yeah. [2:34:26, 2:34:32]: Totalico Road located on incorporate Henry County into the operating limits to allow for construction of mixed use development. [2:34:32, 2:34:52]: Also, we'll deal with a comprehensive plan amendment KCP two zero two three-05 Council District 5. Consideration, of course, the requested and sign a future land use designation of high density mixed use to property 2250 and 2206 Jodica Road. Once again located in unincorporated Henry County into the city's stop. [2:34:52, 2:35:09]: Limits to allow for construction of mixed use development. And once again, rezoning case RZ 2023-06, district council district five, consideration of request to resign uh to assign the zoning district PUD Plan Unit Development. [2:35:09, 2:35:13]: Туффарс атваритту фіфти атвяті о сіка род. [2:35:14, 2:35:23]: Located once again in unincorporated Henry County, and if and after the parcels are annexed into the stop recity limits to allow for construction of mixed use development. Mr. Anderson, please. [2:35:23, 2:35:43]: Okay. Um once again the applicant is Marketplace Storefront LLC. Uh and this is a consideration of request annexed property at twenty-two fifth and twenty-two oh six Jodoko Road from unincorporated Henry County into the city of Stockbridge. The property consists of twenty point four acres. [2:35:43, 2:36:03]: It's heavily wooded. The current county zone is MU, which means mixed use. And the county land use designation is MX, also mixed use. If you look at the slide, you will see an aerial photo of the property: 2250 Jodoko Road and 2206 Jodoko Road, and you can see. [2:36:03, 2:36:06]: [9368.1, 9373.8]: To the south you have um the b the bridges, uh Argento at Bridges and Jotaco. [2:36:16, 2:36:35]: Um properties to the north, you got C2, Henry County. Properties to the south, you got PUD, Plan Unit Development City of Stockbridge. Properties to the east, not applicable. Properties to the west, you got C three heavy commercial, C2 General Commercial, and that's in all in Henry County. Here's a joint zoning map. [2:36:39, 2:36:52]: You can see you got a a lot of C two and MU mixed use and PUD. So the applicants uh proposed rezoning the PUD would be compatible because of the PUD and the mixed use zoning designations in the area. [2:36:58, 2:37:08]: Like uh um previously mentioned, um you got C two to the north in Henry County, PUD to the south, and C three and C two to the west. [2:37:12, 2:37:32]: The surrounding land use, this is related to the comprehensive plan amendment. Properties to the north, you got vacant land, and you got a mixed use land use designation. Properties to the south, you got the bridges of Johtoco, which is high density mixed use, and the applicant is proposing to go to high density mixed use. So that will that would make his pro the proposal. [2:37:32, 2:37:52]: To go to high density compatible and windbill spot zoning. And to the west you got the U Haul Neighborhood Dealer and the Emerson Village Retail Shopping Center, which is also mixed use. And there's another mixed use um land use category which would which also further proves that the applicant proposal to go to um [2:37:52, 2:37:58]: PUD would be compatible with the surrounding community. Here's the joint future land use map. [2:38:00, 2:38:08]: And you can see that the compatibility further further highlighted with the m with the MX, MX and PUD zoning designations. [2:38:10, 2:38:30]: Uh project information the applicant proposes to build a mixed-use development with 320 multifamily units with 612 parking spaces that will be provided to the residents. The proposed mixed-use development will also include a 30-foot thousand a 30,000 square foot retail shopping center with 189 parking spaces that will be provided. [2:38:30, 2:38:35]: Park and a minute area, a car wash maintenance center, and ten foot sidewalks. [2:38:36, 2:38:38]: Here's the the site plan. [2:38:46, 2:38:50]: Here's um a rendering of the the multifamily development apartments. [2:38:54, 2:39:00]: Here's uh a rendering of the the retail, the thirty thousand square foot retail. [2:39:02, 2:39:05]: See that it's a high quality development with a lot of brick. [2:39:11, 2:39:20]: Uh as as it relates to the um the annexation, since the property is contiguous to the city, staff recommends approval uh approval of the annexation. [2:39:22, 2:39:35]: As it relates to the rezoning, s the the subject property is compatible with the surrounding community and the surrounding zoning is also compatible. Staff recommends approval of the rezoning. [2:39:37, 2:39:54]: And I should have mentioned the comp plan prev before the rezoning, but however, the same applies with the comp plan. Um the land uses are similar. The existing land uses are similar to what the applicant is proposing and is also compatible. So staff recommends approval of all three items. [2:40:00, 2:40:01]: I'm ready to answer any questions we have any. [2:40:03, 2:40:12]: Uh thank you for your presentation. All right. Uh since this is in district five, Mr. Alexander, please. I appreciate this and certainly as the city endeavors to [2:40:12, 2:40:32]: grow uh in a quality fashion with smart growth uh and high quality uh product. Certainly we already control uh the south side of Johtoco with the Costco development. We see what's going on with that that's blooming, that's coming out of the ground and it's doing exactly what we want it to do. [2:40:32, 2:40:52]: uh on this particular development. These are uh high-end finishes and certainly I have some questions for the applicant. I do believe that originally in this plan, uh Henry County had actually approved the plan and then the um retail or restaurant component included a rooftop [2:40:52, 2:41:12]: Option. It's it's still part of it. Okay, the rooftop option is still the for the for the rooftop restaurant, correct? Yes. Okay. Well certainly we'll be listening to that portion when the applicant comes forward to talk to us about it. Yeah, and and actually that'd be a good point to do now now the applic applicant come forward and want to give a [2:41:12, 2:41:13]: [9677.4, 9677.7]: [2:41:18, 2:41:19]: Yeah. [2:41:23, 2:41:39]: Now I have to I have to admit, I am surprised because when I met you I thought you were someone else that was going to um have a make a comment for or against certain uh one of the um annexations. I didn't realize you were the actual individual applicant. [2:41:40, 2:41:41]: So to my surprise, we're welcome. [2:41:42, 2:41:49]: Hi, my name is um Kathy Watts Jones. I'm vice president at Marketplace Storefronts, uh LLC. And um [2:41:50, 2:41:52]: I am I live at two [2:41:53, 2:41:57]: two five oh five Harmon Park Court Duluth Georgia and that's in Gwinnett County. [2:41:58, 2:42:02]: Wanna pull up a video? Um [2:42:06, 2:42:10]: I would like to um first of all I want to talk about um [2:42:12, 2:42:20]: On the this new development is going to be on the northwest parallel extension that's going to be going from Jotoko Road north up to Hudson Bridge Road. [2:42:20, 2:42:31]: And the we're gonna have two components on the west side of the parallel expension will be retail. And that we're gonna have we want high quality um [2:42:32, 2:42:52]: uh restaurants we're gonna we're proposing a rooftop restaurant, hop to quality retail shops. And we see the vision of uh city of Stockbridge. We like the synergy, we like the things that are going on here. We thought this would be very good and we would be very compatible with our development. Uh I wanted to we we've we've currently built um [2:42:52, 2:42:56]: This will be our third project in Henry County. [2:42:56, 2:42:58]: We've uh currently built [2:42:58, 2:42:59]: Two. [2:43:00, 2:43:01]: Um [2:43:01, 2:43:02]: Uh [2:43:03, 2:43:10]: I wanna pause this for a minute. We've currently built two uh multifamily uh facilities, resort style. [2:43:10, 2:43:15]: uh resort style apartment complexes in Henry County on J on Jonesboro Road. [2:43:15, 2:43:17]: And we want to bring this project. [2:43:17, 2:43:27]: to the city of Stockbridge. I'd like to show you a brief video of our latest project that is Somerset, which is on Townsend of Village Drive in uh [2:43:27, 2:43:29]: Henry County and McDonough. [2:43:29, 2:43:29]: Okay. [2:43:30, 2:43:31]: All right, let me get this started. [2:45:37, 2:45:53]: So this is our current development that is already forty percent leased. We opened in um May of 2023 here in McDonald's. This facility is already forty percent leased. It's high quality, this is resort style living. Uh we have uh [2:45:53, 2:46:03]: Studios all the way up to three bedroom, three bath units. Our price points range from um the studios twelve hundred dollars up to over three thousand dollars for our three bedroom, three baths. [2:46:04, 2:46:13]: Um our average rents for the entire facility right now is 2200 square feet. And this is the same quality that we want to bring to the city of Stockbridge. [2:46:14, 2:46:15]: Uh we [2:46:15, 2:46:22]: We love what we bring. We bring uh a lot of energy. This it's self-contained. You got media rooms, you got um [2:46:23, 2:46:30]: Uh you've got a f a club room, meeting facilities, um, you name it, we've got it. [2:46:31, 2:46:31]: Okay. [2:46:33, 2:46:33]: Yes, sir. [2:46:34, 2:46:34]: Okay. [2:46:34, 2:46:54]: You you have some questions, sir? Yes. Go right ahead, please. So what you're proposing to build, is there some flexibility in that or is that kind of where you are that the product that you going to build right now? With that that's the product we build. That's the product we bring. It's center centi corridor. Uh we bring secure. We have three locks on all exterior doors. [2:46:54, 2:47:08]: with one of those locks, the only lock on the inside. And we bring all of the units have all the all the bedrooms have walk-in closets. You know, we got granite countertops, we got uh LVL on all the flooring. We bring high quality. [2:47:09, 2:47:29]: Well what I'm referring to is the overall appearance and then Ryan come back over. In terms of where we are in terms of the overall look that we approved on the uh overlay corridor, which is it's not very attractive to have the parking lot in the front of the building, that kind of thing. [2:47:29, 2:47:46]: Right, right. Probably Henry County. But what I'm saying is what w like what we did at Jodico, pretty much the parking is wrapped on the interior and then the building is on the outside. It's closer to the street, where that's the new modern type of feel. [2:47:50, 2:47:52]: Display here that shows the the buildings up on the street. [2:47:53, 2:47:54]: Yeah, that one. [2:47:55, 2:47:56]: I think it's the side plan. [2:47:59, 2:48:03]: Yeah. If you zoom in on that site plan, um [2:48:03, 2:48:05]: Can we zoom in on that? [2:48:08, 2:48:26]: Yeah,'cause that's kind of what it looks like, but the pic what you the video didn't show it didn't show that. So the video was of the facility that we have now. Okay. Well what I see on the rendering is that So this facility here, this is the northwest parallel and and the building is up up to the street. [2:48:26, 2:48:38]: Right. So you you're you're you're closer to the street and the parking is behind the building. Right. So if you if you come in on Jodicar Road, this is the elevation, there's a drop off here. So this'll be green space. You won't you know you [2:48:38, 2:48:58]: Right, right. There's a elevation drop off right there in terms of uh where you're going, but along the parkway it's pulled up and then that parking will kinda be shielded. Okay. Yes, yes. And then on the and on even on the retail side here, the buildings are on the street. This is on Jodoko Road, this side, and this is the northwest parallel on the road. Right. That's the more modern field. [2:48:58, 2:49:18]: With everything's pulled close. You really don't want to drive up and see a big parking lot at a lot of these, especially on the retail spaces. Uh where we're going. And we did get the condition of the ten foot pass, right? Yes. And that's good because uh in the original wish rendition of the Western Parallel Connector. [2:49:18, 2:49:38]: G DOT was only going to pay for five-foot sidewalks along the Jodeco side, along the bridges at Jodeco side, and this side. But with this development, this allows us to expand those paths to ten-foot wide, which will be consistent where we will be able to bike, walk, and even go. [2:49:38, 2:49:57]: golf cart that uh with uh with passage and yeah both of these sidewalks on both sides of the street are template. Absolutely so that's exactly what we want to be able to do to be able to uh fall in line with uh the walkability standards that we've set uh there at the intersection. Um [2:49:59, 2:50:19]: Talk about the I s I see uh you show you has so many amenities in there. And that that pool that we saw, is that what we're getting? No something similar. Each pool is unique. We designed them uniquely for each development. That's the pool that fit in that area. And so we are still in the design phase that was [2:50:19, 2:50:39]: Our first concept. But for here, we we we want something similar to what we just want that in the late. We want something similar to what we just saw. Oh, yes, yes, you definitely have something similar to that with the pool house cabana outside with the outdoor living spaces as well. You have fireplaces, outdoor fireplaces, gaming areas outside. [2:50:39, 2:50:53]: outside and inside. There's game room, interior and exterior, out outdoor spaces. There's car wash, a pet spot, pet wash for the animals outside. We ha also have dog parks within the facility on the on the um [2:50:53, 2:50:55]: on the uh multifamily side. [2:50:55, 2:51:01]: And Ryan, is is any of this signalized, is that intersection signalized at all or no? Which one? [2:51:02, 2:51:03]: Some of this. [2:51:03, 2:51:11]: Right. I know that the whether Judah called is already existing, the one in the middle. Is it signalized to enterize enter that? [2:51:12, 2:51:14]: I don't think so, not now. [2:51:19, 2:51:27]: Is it n is it or is it not? I'm not sure. I don't think so. No. No, it's not. It there's no signal there. [2:51:28, 2:51:48]: Well, let me interrupt for a second. I would imagine we should try to do that because you got the you got you got the departments on one side, you got the commercial on the side. The Western parallel is gonna be quite busy. So I would imagine I'd imagine you're gonna have to have a signal there. I would think so. And if we do when we do have a signal there, I wanna be consistent with what we did at the Jodico side, that we have the black [2:51:48, 2:51:58]: black uh mass post arm signals, not the wooden poles. I hate that we allowed that to go on Jodeco. We should have gotten black posts on Jodeco too. [2:52:00, 2:52:20]: But certainly the requirement would be that there will be black mass posts on signals at those intersections. Everything will be the black crosswalks. And then if allowed, we would do the street print. The street print at those exits right there. [2:52:20, 2:52:25]: There at the entrance on both sides that you would do the street print crosswalk. [2:52:30, 2:52:33]: Well you'd have the stamp paver crosswalks where it would be beautiful. [2:52:33, 2:52:35]: We will do um I think [2:52:35, 2:52:37]: I'm fine with that. I mean whatever the uh [2:52:39, 2:52:40]: G dot allows. [2:52:40, 2:52:45]: It certainly you would request it. If they deny it then there's nothing you can do, right? Yeah. [2:52:47, 2:52:49]: Okay. Th I have no other questions. [2:52:50, 2:52:54]: That's all the questions you have, sir? Yes. Okay, any any counsel, any other questions that you may have at all? [2:52:55, 2:53:13]: I I had a question but I think it's I've talked to Ryan and uh talked to Mr. Alexander on the conditions that he had uh negotiated and well not negotiated but had discussed with the uh developer. And so I'm I'm I'm fine with the uh product. Uh yes ma'am, go ahead please. How many commer [2:53:13, 2:53:16]: How many commercial pieces are part of this property? [2:53:16, 2:53:36]: Well the base the base foot piece is on the west side of east west parallel and that footprint is thirty thousand square feet on the footprint. It could be more than that because we are proposing two-story uh some two-story development with rooftop dining. So the square footage could increase, but the footprint is thirty. [2:53:36, 2:53:37]: Thirty thousand square. [2:53:38, 2:53:48]: So just that portion is commercial right there on the west what is that near the on the west side on the west side of Periloquin. [2:53:49, 2:53:53]: And how do you how many stores do you estimate being there? Retail space is that? [2:53:54, 2:54:00]: Well, um with most of them are what sixteen hundred square foot base on ETF. [2:54:00, 2:54:10]: or bigger, uh a single bay is usually around sixteen hundred square feet. And then um so I would with thirty thousand square feet, probably about eighteen bays. [2:54:11, 2:54:12]: Mm. [2:54:13, 2:54:15]: What do you think the size of the restaurant will be? [2:54:16, 2:54:21]: Um you you'll say our restaurants are a little bit larger. We we developed down on uh [2:54:22, 2:54:42]: um in Henry Marketplace and you've got restaurants anywhere from we've got some that like 5400 square feet, the uh juicy crab. I hope it's bigger than that. We got one that's 8,400 square feet coming down here. So it just depends on the restaurant. Right. It will depend on the tenant. Hopefully it'd be a high quality tenant. [2:54:42, 2:54:43]: A tenant, yes. [2:54:46, 2:54:53]: And the plan for the restaurant would be the one with the rooftop, is that what you guys are saying? Yes. [2:54:54, 2:54:54]: Okay. [2:54:55, 2:55:00]: Any question from the council? That'll be any conditions that that rooftop be included. [2:55:00, 2:55:02]: And plot cameras. [2:55:07, 2:55:15]: All right. On that note, uh I'm gonna open up the I did have a question. I'm sorry, go ahead. Um how many units again for this proposed development? [2:55:16, 2:55:19]: uh three hundred and twenty uh multifamily. [2:55:20, 2:55:21]: Thank you. [2:55:23, 2:55:24]: Any other questions? [2:55:26, 2:55:35]: What are the what's the price point range and how many or one bedroom slash three bedroom or or what's the largest amount of units? Um [2:55:36, 2:55:40]: The the smallest unit is 684 gigasquam. [2:55:41, 2:55:55]: Okay. And that would be our studio. And they go and that's a one bath. And then we have up to a three bedroom, three bath or the three bedroom, three bathroom is seventeen hundred square feet, and the three bedroom, two bath or sixteen hundred uh fifteen hundred and four feet. [2:55:55, 2:56:02]: So take me to the six hundred unit sch studio. How many of those will you have in this proposed plan? [2:56:03, 2:56:11]: The stu the studios we have twenty. It's four per billion. And what's the amount the average amount of cost on the rental for that? [2:56:11, 2:56:27]: Uh right now we're written on studios right around I think it's twelve hundred. No, it can't be twelve hundred. It got to be more than that. Well you might know better than I do, but [2:56:27, 2:56:42]: So it's twelve hundred for a studio. It's six hundred square feet, so I get it. And then one bedrooms right now winning for seventeen hundred eighty thousand square foot. Okay. Two bedrooms average twenty four hundred. Exactly. Two bedrooms is twenty four hundred. [2:56:43, 2:56:52]: And then a three bedroom is it's twenty seven sixty-two for a three bedroom, two bath, three over three thousand for three bedroom, three bath. [2:56:52, 2:56:57]: Okay. And how many three bedroom units do you prepare to have? Thirty six. [2:56:59, 2:57:02]: And then two bedroom units. One hundred and sixty. [2:57:03, 2:57:05]: And one bedroom units. [2:57:06, 2:57:08]: One hundred and twenty four. [2:57:08, 2:57:16]: And so and then you said twenty six uh studios, correct? No, uh twenty. Twenty, twenty studios. [2:57:20, 2:57:35]: So the So the proposal um this is Mr. Tim Jones. He's we've he's the owner of my own. Oh hey Mr. Jones, I've heard a lot about you, but I've never met you in person. It's nice to see your face. Yeah. And he said the mix could change, but we are zoned for a max of three twenty, three hundred and twenty units. [2:57:36, 2:57:42]: Three three hundred and twenty units. The maximum units that's currently chilled, but we're limited to three bedroom. [2:57:45, 2:57:46]: Okay. [2:57:48, 2:57:58]: That sounds like a good move. E limited three three bedrooms. So are there any there are no playgrounds or anything as a part of this? Yes, there are playgrounds. Yes. There are playgrounds. That's thirty six. Yeah, we do have playgrounds. [2:57:58, 2:58:02]: And a dog park and all of that other bunch of amenities. [2:58:03, 2:58:05]: And do it. Walking trails. [2:58:08, 2:58:10]: Any other questions for the council? Thank you. [2:58:10, 2:58:21]: And if not, we'll open up for a public hearing. So uh need uh folks that are on my left side, any c positive comments, comments for the approval of this particular development on my very left side. [2:58:22, 2:58:23]: In the middle. [2:58:25, 2:58:35]: On the right. Any comments that are not for this particular development or something that they need to say that's not uh not in a positive realm on the left side. [2:58:36, 2:58:37]: In the middle. [2:58:37, 2:58:47]: I'm all right. Well in this portion I see nothing for or against, so I'll close out that particular part of the public hearing. And counsel, uh if you have any other comments [2:58:48, 2:59:08]: Please uh is mention that now. If not, we'll go into our voting aspect here. Anything else? All right. So what we have now here is annexation of case AX two zero two three-04 council district five. Consideration request for annexation of property twenty-two fifty and twenty-two oh six Jotaco Road. [2:59:07, 2:59:20]: road located in unincorporated Henry County into the stop bridge city limits to allow for construction of a misuse development. Is there a motion to accept this? Yes, so moved. Is there a second? Mr. Blount second. All fair please indicate. [2:59:21, 2:59:27]: So now it's decision there. Comprehens comprehensive plan amendment KCP two zero two three-05. [2:59:28, 2:59:48]: Once again, Council District Five consideration requested to assign a future land use designation of high density mixed use uh to property twenty two fifty and twenty two oh six Julica Road located in unincorporated Henry County and to Starbucks City limits to allow for construction of mixed use development. Is there a motion to accept this? So moved. Is there a second? We have some conditions. [2:59:48, 2:59:50]: Okay. [2:59:51, 2:59:53]: The conditions are what? [2:59:53, 2:59:55]: That are that are contained within the staff report. [2:59:56, 3:00:10]: Uh trying to find the case. And add the condition this is a well add the condition about the uh the the uh the street print and then the uh mass post arm signals being black. [3:00:11, 3:00:15]: Flock, sorry. In the flock, yeah. [3:00:15, 3:00:16]: The boot. [3:00:17, 3:00:20]: And the rooftop restaurant being required. [3:00:23, 3:00:27]: I have a Mayor Ford, I do have a question. [3:00:27, 3:00:30]: So is this development? [3:00:30, 3:00:34]: Is it facing the interstate or is it facing Jodeco Road? [3:00:34, 3:00:54]: I'm confused about the address says Jodico Road, but you mentioned about the Western it will be facing the north the new Northwest Parallel. Okay. Thank you. And part of the retail will be facing Jodico Road, but the uh multi the mixed uh uh the rep mixed [3:00:54, 3:00:58]: the the multifamily will be facing the new Northwest terrible. [3:01:00, 3:01:03]: So you try what are you trying to find here, guys? [3:01:03, 3:01:08]: Ma'am. Yes, ma'am. Was there an answer on whether or not it was signalized? [3:01:09, 3:01:17]: Uh w I think there were uh it was basically just up the the the conditions that were previous that were previously associated with the case from Henry County. [3:01:18, 3:01:31]: Okay. Right. And if it's it certainly should be signalized as the mayor mentioned with the restaurant with the retail on one side and an apartment the other side, you don't want people go dunk I would imagine that it is signalized. We'll see. [3:01:31, 3:01:31]: Yeah. [3:01:32, 3:01:52]: So what are the additional conditions that are gonna be part of this and we gotta make sure we gotta track that we're in agreement with that? Um the the two the black mass post arm signals, the street print, uh and then the uh flock cameras. The and the and the rooftop re and the rooftop restaurant. And uh conditions that were uh previously [3:01:52, 3:01:56]: Right, on route. [3:01:59, 3:02:07]: Now that we mentioned that, is that in agreement with the developer that the the it's all right with those conditions. We're good. [3:02:11, 3:02:11]: Mm-hmm. [3:02:13, 3:02:13]: Right. [3:02:16, 3:02:20]: I'm sorry, ma'am. You know what? You need it. Come to the mic, please. I'm sorry. [3:02:24, 3:02:31]: The way it's designed now, the ten foot walkways are on the main streets, not within the development. Understand. Okay, and then the [3:02:31, 3:02:35]: The stamp on the road, we want that to be subject to the DOT approval. [3:02:35, 3:02:44]: 'Cause we if they d deny it then we don't want to be hung up on that. Right. Okay. Uh understand. But everything else we mentioned on on the c conditions are good with you on that aspect. All the other things I mentioned. [3:02:45, 3:02:50]: Mm. Oh yes, those are those are acceptable, yes. And Miss Halder you have all those written down? [3:02:50, 3:02:54]: Okay, so we don't need to go through them, we've got them all connected. Okay, so [3:02:55, 3:02:55]: I'm sorry. [3:02:56, 3:03:06]: I'm sorry, you got a question for? Yeah, go ahead, ma'am. Go ahead. This development has on site um does it have on site maintenance and management? [3:03:06, 3:03:26]: Yes, yes. We use professional management organizations to manage all of our developments. We we are a developer. We own the project projects. Uh right now at the Somerset we use Pegasus Residential LLC. They're a national company and they and they manage and they provide also the staffing for the maintenance and all of that. We also in our previous development we use Cortland. [3:03:26, 3:03:38]: And I'm sure you've seen Cortland all around town. Uh they manage that facility for us as well. Okay. [3:03:38, 3:03:48]: There is a mailbox, kiosk, that's located with so it's drive up so that the residents is out is outdoor and it also has a package delivery system as well. [3:03:49, 3:03:50]: Okay. All right. Thank you. [3:03:51, 3:04:03]: All right, so this is dealing with a comprehensive plan amendment for the K C P two zero two three zero five. Mr. Alzheimer, I believe you did a you w have a motion for this, accept this with the conditions? Yeah, with the conditions described by staff. So [3:04:03, 3:04:06]: Is there a second? Mr. Blount, second in all in favor, please indicate. [3:04:07, 3:04:08]: I do have a question. [3:04:09, 3:04:12]: Um the access to the right. [3:04:12, 3:04:13]: Go ahead. [3:04:13, 3:04:17]: Access points. Um this is a request for [3:04:18, 3:04:30]: Is this the comprehensive plan amendment case that we're No this is the yeah comprehensive plan amendment, that's correct. So the high density. The access points. Is there only one access point for this development? [3:04:32, 3:04:39]: So what we're asking for, the access access point, the main access point is here, and this is also an entrance exit here. [3:04:39, 3:04:40]: There's two. [3:04:41, 3:04:43]: On this side of the m on the multifamily side? [3:04:44, 3:04:46]: And then we have the access point here. We [3:04:46, 3:04:53]: We've asked for a a write-in right out here, but that's not on this site plan, but we've did requ ask for that. [3:04:53, 3:04:54]: Killed the [3:04:54, 3:04:55]: Thank you. [3:04:56, 3:05:02]: All right. Mayor Ford, those can yes, sir. Mayor Ford, those those conditions supposed to be with the rezoning, not the complaint. [3:05:03, 3:05:22]: Okay. Okay. So the which which one? Which which uh all of them we just mentioned or just Yeah, all of them that we previously mentioned they're they're uh with the rezoning, not the complain. All right. Comp plan doesn't have any conditions. Sorry about that. All right. So otherwise we need okay, we okay, uh Mr. Alzheimer's you need to re restate your emotion then please. [3:05:22, 3:05:28]: Uh so well I wanna approve it as uh described by staff. [3:05:28, 3:05:29]: Okay. [3:05:30, 3:05:31]: Okay, Mr. Blount, second then. [3:05:32, 3:05:34]: Any other questions? All Flavor, please indicate. [3:05:35, 3:05:55]: All right, examined decision. Now when it comes to the rezoning case, ha ha all right. RZ two zero two uh two three dash zero six council district five consideration requested assigned the zoning district to PUD Plan Unit Development to four parcels twenty two fifty and twenty two oh six Jodico Road locate unincorporated Henry. [3:05:55, 3:06:06]: County and excuse me, if and after the parcels are annexed into the city limits stop bridge, allow for construction of mixed use development. Now this is where all the additional conditions come in. Okay. [3:06:06, 3:06:15]: Now the ones that were previously stated and then what we added tonight. Yes. Okay, so it's that's a total of what, uh nine different conditions? [3:06:16, 3:06:20]: But miss I'll tell you what, let's go through this. Miss Holiday, what conditions do you have? [3:06:25, 3:06:36]: Yeah, what what would what the black top I mean the black mask, rooftop, the street pavers with the subject to uh G Dot's approval and flop camera. [3:06:38, 3:06:44]: Okay. Those were added to the questions would have been included in the uh staff report. [3:06:44, 3:07:04]: Okay, those are added to what was already initially uh brought forward by the by the staff. And once again, all those conditions that we that were previously stated and also what we added tonight are all good with the developer. Yeah. Okay. Let me answer your question. Now, uh we have street lights and uh associated with this. Yes. [3:07:04, 3:07:16]: Sir. Okay. It is required in the in parking. Okay, correct. Okay. Wait, Mr. Alexander, what's your motion? Uh I would like to motion to approve with all the added conditions described by staff. [3:07:17, 3:07:21]: Okay, is there a second? Mr. Blount Suckedena. All in favor, please indicate. [3:07:22, 3:07:28]: Genamous decision. Thank you very much. Congratulations. Look forward to this. Welcome to stock reading. Absolutely. Put it back for you. [3:07:29, 3:07:36]: All right, what we have next, adoption of the FY twenty twenty four operating budget and capital expenditures presented by Mr. Gardner, please. [3:07:46, 3:07:48]: I'll do the first. [3:07:54, 3:07:56]: Good evening once again, man, council. [3:07:58, 3:08:13]: So we've had our first two um readings on the b on the fiscal year twenty four budget, November thirteenth and november twenty eighth. This is a third reading of the budget for the adoption of the budget. By law you're only required to have two readings. [3:08:13, 3:08:33]: uh and the adoption thereof. Our budget and the general fund is set at twenty six thousand one hundred seven hundred and eleven seven hundred thousand seven hundred and eleven thousand six hundred and thirty six dollars for the general fund. I'll repeat twenty six thousand seventy six million seven [3:08:33, 3:08:53]: seven hundred and eleven thousand Jesus seven hundred eleven thousand six hundred and thirty six um dollars um overall general fund for the overall budget for the city including our enterprise funds as well as our spLOS uh funds is sixty one million [3:08:53, 3:08:56]: One hundred and thirty four thousand four hundred and seventy eight dollars. [3:08:57, 3:08:58]: Um you know. [3:08:58, 3:09:03]: Okay. Second question. Any questions for Mr. Gardner staff? I'm counsel, I'm sorry, council. [3:09:04, 3:09:05]: Yeah, for Yes, sir. [3:09:07, 3:09:10]: Mr. Gardner, thank you again for that. Um [3:09:11, 3:09:14]: At the last hearing I asked the question. [3:09:15, 3:09:18]: about the balancing of the budget. [3:09:18, 3:09:38]: And I asked um if there would be any um use of any other um entity or department to to actually to balance the budget. And I think at that time uh use [3:09:38, 3:09:45]: said uh no, I believe. So here during the adoption phase [3:09:45, 3:09:49]: Is there any other um [3:09:52, 3:10:05]: Any other financial entity that would be needed to balance this budget? No, sir, the bullet. The budget as presented to you, a budget is balanced across all f the general fund. [3:10:05, 3:10:10]: Um through our revenue sources, um, which are mainly property tax, sales tax. [3:10:10, 3:10:13]: Permit fees, fines, forfeitures, um, and such. [3:10:14, 3:10:16]: Okay, and and the reason I ask is if you recall [3:10:17, 3:10:20]: Um the the last year's budget. [3:10:20, 3:10:22]: We had to use [3:10:22, 3:10:24]: Uh another [3:10:24, 3:10:29]: uh financial source to to balance the budget, but this year we do not. [3:10:29, 3:10:31]: We do not anticipate that, sir. No, sir. [3:10:35, 3:10:37]: Any questions from the council? [3:10:38, 3:10:57]: Um I'm I'm I'm sorry, were you done, sir? I'm sorry. Well, I I don't have another question, but I do have something else, but I'll I'll yield to any other council members if they have a question. Ms. Barber, go ahead, please. Yes, I just wanted to make sure, and just for the record, the engagement letter um issued for Malden and Jenkins. Um [3:10:58, 3:11:02]: А стіл хавнга. Ам стіл куриос і мрісте. [3:11:02, 3:11:07]: in the audit of the budget amendments and budget adjustments from twenty twenty two. [3:11:08, 3:11:08]: Um [3:11:09, 3:11:10]: I am [3:11:10, 3:11:11]: Reluctant. [3:11:12, 3:11:14]: to approve the adoption. [3:11:14, 3:11:17]: Because I wanna be able to see what the audit [3:11:17, 3:11:18]: Results were. [3:11:18, 3:11:19]: That's all. Thank you. [3:11:20, 3:11:20]: Yes, well. [3:11:21, 3:11:35]: Can any comments uh uh c Mr. uh Thomas, you have something else you want to add? Mayor Ford. Yes, ma'am. May I just ask um Mr. Gardner, can you please email that information to me as soon as possible? I was good before I leave here tonight. I appreciate it. You're welcome. [3:11:35, 3:11:42]: Mr. Thomas Quay, please. Yeah, I I I wanted to make a motion after we have exhausted all of the questions. [3:11:44, 3:12:00]: So if that's another question, Mr. Garner, I'd like to motion, and I wrote this down here, I'd like to motion to amend the city's organizational chart to move the events and the conference center. [3:12:00, 3:12:01]: Wonder [3:12:02, 3:12:03]: economic development. [3:12:12, 3:12:24]: Okay. I mean I w I uh okay we uh he made a motion we can also ask for a second emotion, but I imagine it would be some type of discussion on this'cause it's I have to admit, this is the first I've heard of this this this uh this aspect. [3:12:25, 3:12:29]: Uh just it just sort of dawned on me in a number. Well [3:12:33, 3:12:35]: I don't want to [3:12:36, 3:12:56]: disparage anyone or any department with this motion. But I just feel that for better operation that we guess and the conference center operation would function better. Uh presently is [3:12:56, 3:13:00]: It is under the city bench. [3:13:00, 3:13:04]: under uh every number. [3:13:05, 3:13:07]: Okay. Thank you. Yes, ma'am, you [3:13:07, 3:13:27]: Um, I i this kind of and Councilman Thomas, thank you for your opinion on that. I think this kind of caught me off guard. This is my first time hearing anything similar to this. Um and to me it could possibly um be a discussion um [3:13:27, 3:13:39]: for personnel, under exec in executive session. I mean, I just I kinda just gotten thrown off by it. Or maybe we can you know, revisit it at another time, but [3:13:40, 3:13:51]: I'm I'm not prepared to vote for that today because this is my first time hearing it. I'm not saying I'm against it. I just need [3:13:51, 3:13:53]: To hear a little bit more. [3:13:53, 3:13:56]: Well let me just e explain a little bit more. Uh [3:13:57, 3:14:07]: That's what I'm saying, Councilman Thomas. For the morale of the of the city. But it would not change it would not change the budget at all. I understand. [3:14:07, 3:14:12]: It's only an organization, a chart move. [3:14:12, 3:14:24]: I understand. Do you n you understand what I'm saying about it though? Like I I wanna hear a little bit more. I I just think that it's something that could possibly be discussed in executive session. [3:14:24, 3:14:37]: Let's do that. Okay. Mr uh for personnel. Thank thanks for it. Mr. Blood, you had a comment? Yeah, I agree to discuss it in Zag Session because if you change um if you remove it and put it up under the [3:14:37, 3:14:57]: Um, economic development director, the scope of work first of all changes. Yeah. And the um his specific duties changes because now he's got to get insight on what these two entities are doing, how they operate, what they're doing. It it just changes everything. Um I I just would hope that in the future. [3:14:57, 3:15:01]: the city gets to a point where well [3:15:04, 3:15:08]: If people are doing their job, then the job will get done. That's all I'm saying. [3:15:10, 3:15:20]: Alright, so Mr. Thomas, is y you'll be all right to having this second session discussion anyway before we go forward with this? Well, I I don't I don't have a problem with that. Um [3:15:21, 3:15:22]: You know [3:15:23, 3:15:26]: My concern is and a and again [3:15:26, 3:15:29]: I I don't wanna disparage anyone, but [3:15:29, 3:15:40]: The purpose of these hearings, the budget hearings, is to do just that. It's discuss the budget. Now whether [3:15:41, 3:15:45]: And if and if if if this was something that [3:15:47, 3:15:55]: That came to me yesterday, I would have put it out to the foot for the council just to get their thoughts on it. But it's not [3:15:57, 3:15:59]: It does not change the [3:16:00, 3:16:10]: the finances. It does not change the duties of the event staff or the conference staff. [3:16:11, 3:16:13]: It's just a move. [3:16:15, 3:16:16]: Imam. [3:16:17, 3:16:21]: For better operations of that particular entity now. [3:16:23, 3:16:25]: This is not the first discussion. [3:16:26, 3:16:31]: that we have had a matter of fact at the last council meeting when we talked about [3:16:32, 3:16:33]: The budget. [3:16:33, 3:16:36]: We talked about the conference center. [3:16:37, 3:16:42]: and the events. So that's why I thought that we had sorta discussed [3:16:43, 3:16:45]: That entity [3:16:47, 3:16:57]: And I just thought this would just be a a move that council would sort of understand because we have discussed this not only this year. [3:16:57, 3:16:59]: We've discussed this every year. [3:17:00, 3:17:03]: about the conference center and the event staff. [3:17:03, 3:17:10]: So it's not like this is the first time that any of us have heard this discussion. [3:17:11, 3:17:14]: And again, last month we talked about [3:17:14, 3:17:16]: Some of the shortcomings. [3:17:17, 3:17:17]: Oh [3:17:18, 3:17:21]: The conference center and the events. [3:17:21, 3:17:29]: So I just thought it would just be a natural move, but I'm willing to discuss it here now. I don't know if it should be [3:17:30, 3:17:34]: Uh an executive session, we're not talking personnel. [3:17:34, 3:17:51]: Well, I I have to admit I've but d you mentioned on a couple of occasions that this doesn't change the budget the budget uh f and this is a budget here in any way or the other. It's it's to me like it's more like a personnel change'cause you're changing no it's not personnel. Well that's why I'm looking at it. It's organizational chart move. Well, I mean it deals with personnel though. [3:17:51, 3:17:59]: It deals deals with personnel. But anyway, uh I I'm I mean that's what caught me by surprise personally. I mean I I don't think if we're gonna I think [3:17:59, 3:18:18]: You know, up to the council, but I think if we're gonna discuss it, it'd be a it'd be an executive session discussion versus doing it right now, right here on a budget on this particular budget hearing because once again it doesn't change the overall number in the budget. You indicated that a couple times already. Right. So I mean that's what we're supposed to be dealing with. The organization, a chart is a part of approving of the budget. [3:18:19, 3:18:19]: Okay. [3:18:20, 3:18:32]: Mayor. But but I but I would concede to discussing it later. I mean I I don't wanna get into a back and forth about it. I I mean it it's okay if the council wanna just leave it like it is. [3:18:32, 3:18:34]: But the only problem is [3:18:34, 3:18:37]: I don't want us to to continue to come back [3:18:38, 3:18:40]: And talk about the shortcomings. [3:18:41, 3:18:42]: Of the mural. [3:18:43, 3:18:46]: the events are the conference center, if we're not willing to [3:18:47, 3:18:50]: Іно мек чайс федера. [3:18:50, 3:19:05]: Uh all right, so appreciate it. Mayor, I think we need to uh caution ourselves when we go in specifics and hold those specifics for executive session because we do have personnel in those areas that we're speaking of. [3:19:05, 3:19:06]: Right. [3:19:07, 3:19:13]: All right. Um any other comments in reference to Mayor, in closing. Yes. I'm sorry. In closing. Yes, sir. Go ahead. [3:19:13, 3:19:19]: has nothing to do with personnel. It changes nothing about staffing, period. Nothing. [3:19:20, 3:19:20]: Mayor. [3:19:20, 3:19:21]: But uh but [3:19:21, 3:19:28]: Ma'am, we'll we'll just close on. I I I won't May uh I'll just withdraw. I'll withdraw the motion. Okay. All right, no problem. Yes, ma'am. [3:19:29, 3:19:49]: Well, I I I understand we were withdrawing, but I do wanna have I do wanna say something about that. I agree with you, Mayor. I think that it is part of personnel. We are talking about the budget. Even though the org TAR is attached to the budget, you're talking about chang not necessarily changing someone's position, but putting another layer on top of a [3:19:49, 3:19:55]: department and I'm not against it. I'm what I'm saying is there are other discussions such as [3:19:55, 3:20:05]: Do you wanna add that to an economic development or do you want him to focus on economic development? Or do you know, so there's a lot of things that I would rather discuss, but I don't think [3:20:07, 3:20:15]: On the dies is the place to do it. I think that the appropriate place is to discuss the reasons why we're doing this and what and what's going on. [3:20:16, 3:20:24]: in executive session if we were to do anything. That's why. Okay, fine. So outside of outside of that, any any other comments on the budget, if not. [3:20:24, 3:20:27]: I'll ask for a motion to accept the budget as it is stated. [3:20:28, 3:20:30]: So move. Is there a second? [3:20:31, 3:20:32]: Is there a second? [3:20:33, 3:20:33]: Sorry. [3:20:33, 3:20:37]: Mr. Alzheimer's second, all in favor of the budget, please indicate. [3:20:38, 3:20:41]: I'll pose. You sustain? [3:20:41, 3:21:01]: I will abstain. All right, four zero one stated my reason why earlier. Okay, four zero one uh uh uh passed. Okay. On that note, thank you, sir. Um what we have next is new business, but the the next three items on new business all deal with uh uh appointing people to certain committees. I did not well know whether or not we needed to go in this legacy session to discuss these or whether or not we do [3:21:01, 3:21:11]: do them out here in open session. You got the fill in you got requirements to fill the citywide development authority, you c Council Advisory Committee and also the Downtown Development Authority. Um [3:21:13, 3:21:19]: Yeah, well see yeah th and I think they're they may be more than one per section, potentially here. You have to look at'em. [3:21:20, 3:21:28]: So I didn't know if you wanna do this now or whether you wanna go into session, have that discussion, then come back and make those announcements. It may only be one per s section. [3:21:29, 3:21:31]: I'm sorry, ma'am. [3:21:31, 3:21:31]: Okay. [3:21:34, 3:21:36]: So go ahead. Go ahead, Madam Clerk. [3:21:36, 3:21:41]: We have two vacancies. Madam Clerk, you only c Yeah, come come forward please. [3:21:51, 3:21:57]: All right, good evening. So we have two vacancies on the city wide development authority. Okay. [3:21:57, 3:22:01]: And we have two applicants. Okay, two two and two applicants [3:22:01, 3:22:18]: a number of vacancies on the Stockbridge Youth Advisory Council, but we only have one applicant at this time. Okay. And for the DDA we have one vacancy that will happen with at December thirty first because we have a current um member [3:22:19, 3:22:22]: Who submitted their intent not to [3:22:23, 3:22:43]: remain on the board and will terminate at the end of this year. So this um application, the one application that we have would fill that vacancy. So otherwise for what are vacancies we have, we don't have we don't have overabundance like we don't have three or four people for one vacancy and things in that nature. It seems like it if we want to go through this we can go ahead and point it and it'll fit perfectly, I guess. [3:22:43, 3:22:46]: Yes sir. [3:22:46, 3:23:06]: I um I motion that we approve those three vacancies with the applicants for the positions that are salt police. Let's go one let's go one at a time, sir. Um okay Let's let's just go one at a time. Okay. Oh we'll s what's your question? My question is for the citywide development authority, are we gonna consider districts reps representation? [3:23:07, 3:23:15]: I I that's a good question. I I have not uh I w that's another thing we haven't discussed. At least I don't I've not been involved in discussion of that that I know of. [3:23:16, 3:23:19]: And I I kind of I know we had talked about it at one point. [3:23:20, 3:23:21]: Um [3:23:22, 3:23:35]: you know, possibly considering that so that we can make sure that we have a variety uh spread throughout the entire city. I think that that would be appropriate and not, you know, and so that it would be balanced. [3:23:36, 3:23:39]: throughout, especially the city wide I mean it's city wide. [3:23:39, 3:23:42]: So I I kind of wanna start [3:23:42, 3:23:45]: uh moving toward in that direction where we make sure that we [3:23:46, 3:23:48]: that each district has representation. [3:23:49, 3:23:54]: So on both the citywide and the D DA they have specific criteria? [3:23:54, 3:23:57]: Where you have to be a uh downtown. [3:23:57, 3:24:03]: Um, business owner. That's for D a resident. So I don't you don't have [3:24:04, 3:24:22]: But this five or six different um set of criteria that you could use to do that. Likewise for the D DA, you can be in the county, you can be a business owner, you could be a realtor or a banker. It does not state in your current um code that they be [3:24:24, 3:24:35]: Right. Uh district represented. So my concern is there are certain uh how many members are there on the city wide development authority? Seven. Okay. Including a member of council. [3:24:35, 3:24:40]: Okay. We don't have a member of council on the citywide development authority. Your [3:24:40, 3:24:41]: The um [3:24:42, 3:24:43]: Ordinance. [3:24:44, 3:25:04]: And the D DA by the D A law calls for a member of the governing body. It's just seem vacant. No, no, no. So I was on the D D A. I get that. The D D A I mean the city wide as well, a a a council member. Right. So I just want to focus on the city wide development authority right now. The D D A is specifically for downtown, so I get it. I'm not [3:25:04, 3:25:24]: Talking about that, there's specifics for that. Particularly, we hope to get mainly the businesses that are in downtown area to be on the DDA. Um, downtown development authority, downtown people who business owners who are there. That's common sense. But what I'm concerned about is the citywide development authority, even though [3:25:24, 3:25:31]: So they do have certain requirements and certain terms. Let's say they have we have five council members and a mayor, right? [3:25:32, 3:25:45]: Or we and then there might be a requirement that yes they have to somebody has to be on a and a business owner. I'm not necessarily sure what the city wide development authority requirements are, but [3:25:45, 3:25:50]: If each district I mean, I have businesses in my district. [3:25:50, 3:25:55]: Everyone does. And so I wanna I just wanna make sure that we [3:25:55, 3:26:01]: try to balance it out. And we had talked about this before and that I think would be fair. [3:26:02, 3:26:12]: And that's just part of the discussion for me. No offense to anyone. I just think that we need to think about that as far as representation is concerned, citywide. [3:26:14, 3:26:25]: Well, you know, we got it from the state. Yeah, I think what I was gonna say, I think we would probably have to do that we'd probably have to go back and change some make some changes in the charter or whatnot, staffing or whatever to do. [3:26:25, 3:26:30]: Uh designated. So I would think we would have to r and would these Where's the attorney? [3:26:30, 3:26:33]: She's over there. She's she's s she'll be s ma'am. [3:26:33, 3:26:44]: Can you come over here for me? Do you have an answer for us at all? Like with the city wide development order water requirements? Thank you, Miss Holliday, and I appreciate you with that. I and I I know what you're saying and I agree. [3:26:45, 3:26:47]: I just want to see what we can do and what we can't. [3:26:48, 3:26:55]: I'd have to pull the actual statute for you, but the Citywide Development Author the Citywide Authority is similar to the DDA. There are specific requirements in statute. [3:26:56, 3:27:07]: that outline what the vacancies sh how they should be filled. And it doesn't outline that there needs to be someone from each district as you outline to be appointed. [3:27:07, 3:27:09]: If you all want to do that as a counsel. [3:27:10, 3:27:16]: You could as long as it wasn't in violation of the current statute. I was gonna say if it's if it's a statute that we gotta follow, we we probably couldn't do that. [3:27:16, 3:27:28]: As long as it would the statute doesn't say you can't. So if you wanted to as a council make it to where it's per a person per district, you could. As long as you continue to meet the other requirements. [3:27:29, 3:27:44]: Hm. Okay. So that makes a big big difference. It doesn't speak to a person from a district at all. So you if you wanted to have a person per district, you could. [3:27:45, 3:27:50]: By council. You'd have to add extra members to do that? Yes. Basically. [3:27:51, 3:27:52]: That's a lot. [3:27:52, 3:27:52]: All right. [3:27:53, 3:28:13]: Okay. So f food for thought for later. I I maybe because these this type we have a timeline here and these these vacancies to get them done. But anyway, what I like to do is that w uh council consideration to fill the vacancy to appoint member of the citywide development authority, fill an uninspired term and and uh what I have here what what we have here is uh Davarek Morgan is the only individual [3:28:12, 3:28:15]: Oh wait a minute now, hold on. [3:28:15, 3:28:17]: Is that was it uh [3:28:18, 3:28:20]: Debric Morgan and [3:28:20, 3:28:22]: Terry Terry Marie Cleeton. [3:28:22, 3:28:27]: And and they're those are two those are two people, right? They're two people and they have two vacancies. [3:28:27, 3:28:29]: Yeah. [3:28:29, 3:28:41]: If okay. So if there uh I don't know whether or not the motion to approve. Mokay, Mr. Bless said motion to approve. Is there a second to that motion? Second. Mr Mr. Second. All in favor, please indicate. [3:28:42, 3:28:45]: Is he not okay, all posed? You you approve? [3:28:45, 3:28:58]: Okay, so it's a Navajo decision. All right, then uh council consideration to fill vacancy appoint member of the youth council advisory committee to fill an expired term. And what we have, uh have one person of Paige Jones. [3:28:59, 3:29:04]: Okay, from ms Mr. Blount to Ms. Gantt, all in favor please indicate. [3:29:05, 3:29:15]: You now see n Mr uh Thomas? Okay, you good? All right. She announced decision there. And then council consideration to fill vacancy to appoint member of downtown development authority to fill unexpired term. [3:29:15, 3:29:17]: And I have a Darrow Stamper. [3:29:17, 3:29:18]: Okay. [3:29:18, 3:29:19]: Is that to only one person? [3:29:20, 3:29:24]: All right. [3:29:24, 3:29:27]: You did Ms. Gantt? Okay. Ms. Gantt second that on fair please in the K. [3:29:28, 3:29:29]: Uh, financial season, okay, fine. [3:29:31, 3:29:32]: All right. [3:29:33, 3:29:38]: Well we have now the announcements of upcoming uh meeting events. Uh let's see here. Like I tell anybody, nobody comes into this position [3:33:46, 3:33:51]: None of us in order to say, hey, I'm gonna go in there and mess up the city. [3:33:51, 3:33:53]: Everybody up here has a heart for the city. [3:33:54, 3:33:57]: And I uh my prayers are with each and every council member up here.
