[0:03:29, 0:03:29]: Chair. [0:03:31, 0:03:31]: Yes sir. [0:03:32, 0:03:37]: With the um notion to defer item number two, I make a motion that we approve tonight's agenda meeting. [0:03:38, 0:03:41]: Mr. Jaden approves. Can I have a second, please? Second. [0:03:41, 0:03:44]: Mr. Thompson seconds passes. [0:03:45, 0:03:50]: All in favor? Aye. Aye. Aye. Aye. Motion passes. [0:04:03, 0:04:07]: I'm sorry, Mr. Jaden made the motion. Mr. Thomas seconded. [0:04:07, 0:04:08]: Thank you. [0:04:09, 0:04:11]: The motion was approved. [0:04:15, 0:04:20]: Okay, I'd like the commission to review the approval of the minutes in the last meeting of july eighteenth, please. [0:04:56, 0:04:58]: Okay, so everyone had the opportunity to review? [0:05:02, 0:05:14]: May I have a motion to approve the summary minutes of the last meeting? Mr. Chairman, this is David Planchon. I'd like to make a motion to approve the minutes from last meeting. Do I have a second? I second. Matthew Thomas. [0:05:17, 0:05:20]: All in favor? To approve? Aye. [0:05:23, 0:05:28]: All right folks, before we get started tonight, um very quickly [0:05:29, 0:05:33]: Just want to go over a few ground rules for the meeting, please. [0:05:34, 0:05:45]: So I do want to welcome everyone to the Planning Commission meeting. I'm Anthony Mitten. I'm the Vice Chairman of the Planning Commission. Uh the other members of the Planning Commission are Stanley Doumas, who's not here tonight. He's also the chairman. [0:05:46, 0:06:00]: Uh Harold Thibodeau, David Planchin, Jaden Williams, and Matthew Thomas. The staff members are Ryan Anderson, Community Development Director Meredith Garmin, City Zoning Attorney Keedra Jackson, Chief Planner, Linda Logan, Senior Planner, [0:06:01, 0:06:18]: uh Gordon Linton, who's also a planner. So there's a few protocols that we want to talk about for the meeting tonight. First off, we want to make sure that we keep our comments and presentations on a professional level. Uh wanna deal with the facts that are important for this commission to make its decision. We do not accept comments that are considered by [0:06:18, 0:06:22]: Uh, the chair to be a personal attack on any individual or group individuals. [0:06:23, 0:06:28]: You'll receive a warning from the chair if you deviate from this requirement. A second deviation will result in a request. [0:06:29, 0:06:31]: For you to leave the meeting and the premises for the evening. [0:06:32, 0:06:42]: Uh please refrain from any applause or comments from the audience. Only one person will be talking at a time and all comments will be made at the podium after the speaker who's been recognized by the chair. [0:06:43, 0:06:48]: Please direct all comments to the chair and the commission, not to the audiencers of the staff. [0:06:49, 0:06:51]: Please do not apply to react to speakers. [0:06:51, 0:06:53]: Speak from the audience, Chair. [0:06:53, 0:06:54]: Carry on a conversation. [0:06:55, 0:06:58]: What chairs in the audience or disrupt the order of this meeting in any way? [0:06:59, 0:07:01]: Be aware that these hearings are not a debate. [0:07:01, 0:07:03]: Or an opportunity to ask questions. [0:07:03, 0:07:08]: Which must be answered by any individual tonight, but are merely an opportunity to present information to the commission. [0:07:09, 0:07:12]: Other than the applicant, no person may speak more than once [0:07:13, 0:07:18]: The applicant may reserve part of his speaking time as a rebuttal and may speak next and last. [0:07:19, 0:07:27]: He may use the entire minutes allotted the allot the entire ten minutes allotted for the pro side of the application. Other than the applicant, no person may speak longer than five minutes. [0:07:29, 0:07:36]: If you have a cell phone or other electronic device, I ask that you either power them off or put them on silent mode. So if you haven't done so, please make sure you do that now. [0:07:38, 0:07:53]: If anyone wishes to speak tonight, please fill out a form available on the table up front and hand it to the staff before approaching the podium. So you'll see these up front. Please make sure that you do sign your name. I believe it has your name and your address. Fill that out completely before you're called or before you approach the podium. [0:07:55, 0:08:11]: After each case is called, we will hear next from the uh city staff and then we will hear from the applicant or the representative about what their plans are for the property, along with any other relevant information they wish to present. The commission members will be free to ask questions at any time before the vote on a project. [0:08:12, 0:08:15]: Following the applicant, anyone who wishes to speak for or against the project. [0:08:16, 0:08:21]: Or just ask questions and we'll have an opportunity to do so. Each side is restricted to a maximum of ten minutes. [0:08:22, 0:08:28]: Or time may be waived at the discretion of the presiding official. If questions are raised, we may ask the applicant to speak again. [0:08:29, 0:08:31]: Afterward we would call for a motion and a second. [0:08:31, 0:08:34]: Have any necessary discussion and if the matter's not tabled [0:08:35, 0:08:43]: We will vote to recommend approval or denial of the application. This commission is only a recommending body. Please understand that. We are only a recommending body to the city council. [0:08:45, 0:08:51]: The items will be heard by the mayor and the council, whether we recommend approval or recommend denial, unless tabled. [0:08:51, 0:08:56]: Those item these items will be heard by the city's mayor and council at the next meeting on Monday, the twelfth of June. [0:08:57, 0:08:59]: and voted upon by them at the meeting. [0:09:01, 0:09:09]: Uh so we do have the first case tonight would be the Patrick Henry Master Parkway Master Plan. I'm sorry, Park Patrick Henry Parkway Master Plan. [0:09:10, 0:09:11]: I'll read that into the record. [0:09:12, 0:09:15]: Um that's for council district five consideration of the [0:09:15, 0:09:20]: Patrick Henry Parkway Master Plan, which was prepared by the TSW consulting firm. [0:09:21, 0:09:34]: It proposed a mixture of retail, commercial, residential, and entertainment uses for areas along the southern end of Patrick Henry Parkway, with some properties lined within the Stockbridge city limits and others lined within unincorporated Henry County. [0:09:39, 0:09:41]: Okay, staff will now present the item, please. [0:09:49, 0:09:50]: Good evening, everyone. [0:09:55, 0:10:15]: I am going to attempt to present in this heat. My name is Kedra Jackson, Chief Planner of the Planning and Zoning Division. Tonight, before you, we would like for you to consider a citywide initiated rezoning by the City of Stockbridge. And the intent here is to rezone properties. [0:10:15, 0:10:21]: Um there are parcel numbers listed in your staff report, the copy of your staff report, but for the [0:10:28, 0:10:48]: The intent is to rezone the property from rural residential RR to planned unit development, PUD to allow for a mixed-use development. The subject properties range from the southern portion of Patrick Henry Boulevard, Parkway, excuse me, to the endpoint of Holloway Road. [0:10:48, 0:10:56]: The subject properties consist of various owners and contains approximately more or less 41.68 acres. [0:10:58, 0:11:18]: Again, the proposed development is a misuse development that will consist of residential components as well as office complexes, retail, hotels, or and different other misuse components. The established valuation of the project consists of 350. [0:11:18, 0:11:32]: fifty million dollars. It will also contain entertainment venues, restaurants, establishments. Also job opportunities will be presented to the citizens of the city of Stockbridge. [0:11:35, 0:11:40]: This property is located in District Five, Land Lot forty six. [0:11:41, 0:11:55]: As I mentioned, there are various owners that are aware of this rezoning and have consented to the city in moving forward with the rezoning. There is no history on this property. The property is vacant in nature. [0:11:56, 0:11:59]: And it would help if I move the PowerPoint here. [0:12:00, 0:12:15]: So this is the site plan of the proposed development. Um the subject property currently is vacant, heavily wooded, um, and as you can see it has a irregular shape to the him explained that to you. [0:12:18, 0:12:35]: Again, this is the site plan, the proposed site plan of the development. And this shows an aerial view of the property. So as you can see, there is residential development to the east of the property, vacant land. [0:12:35, 0:12:51]: goes all the way to Holloway Road, um to the west, again vac vacant land. And as I mentioned in twenty twenty three there was a proposed or uh um approved development to the north of this project of this property. [0:12:53, 0:12:57]: This is the zoning map of the property. [0:13:00, 0:13:12]: The the stars moved to the right a little bit, but um the yellow portions are the rural residential components and as you can see the arrows showing where Holloway Road is located. [0:13:15, 0:13:22]: This is a street view of the site towards that southeast corner of the subject property. [0:13:27, 0:13:30]: And here is the future land use map. [0:13:31, 0:13:51]: So what we're gonna do is just um the future land use map currently is showing um misuse residential, misuse residential. We're going to maintain the land use there. Um in your staff report you may see that um there was a um [0:13:51, 0:13:58]: Um statement that we may change the land use. We're not going to move forward with that. We'll just keep it here. [0:14:02, 0:14:12]: This does coincide with our comprehensive plan. Um, our comprehensive plan does calls for the development of misuse and office and retail. [0:14:12, 0:14:16]: Um the proposed mix use development will help to meet that need. [0:14:17, 0:14:27]: The companion future land use map shows a land use destination of high density residential. So I applied apologize. I think I said misuse before, but it's high density residential. [0:14:28, 0:14:44]: So this will include both residential and commercial uses. The compatible land use destination can be high density mitz use, but again, we're not um intending on changing the mitts use here. So the rezoning will be the only change that will be made. [0:14:44, 0:14:51]: Here is a proposed visual of what the development could look like. [0:14:52, 0:15:00]: And we are still in the planning stages of what um the architectural materials will consist of. [0:15:04, 0:15:21]: And there's another image of the proposed development. We are just presenting this tonight. We're not asking for a vote. Um this may come back before you. And um I will now hand it over to the city manager. [0:15:25, 0:15:26]: Good evening. [0:15:27, 0:15:28]: Um [0:15:28, 0:15:35]: As Ms. Keejo stated, this this has been a plan uh we've been working on with the property owners along that corridor. [0:15:35, 0:15:37]: uh for the last year and a half. [0:15:37, 0:15:40]: Um working along with TSW on behalf of the city. [0:15:41, 0:15:48]: And the intent behind this was not to have another major corridor that looks like the same with a bunch of strip centers and so forth. [0:15:49, 0:16:00]: So with that in mind, we took a proactive approach of working with the landowners to land plan this project to something that you typically see not see on the south side of Atlanta, or should I say south of I twenty. [0:16:01, 0:16:03]: You see this in the Brookhaven? [0:16:03, 0:16:11]: You see this in the Sugar Hill, you see this in the Swanee, you see this in the Alpharetta area. Um [0:16:11, 0:16:18]: And working with those guys to say, hey, how do we do something different here that hasn't been done on the south side of Atlanta? [0:16:18, 0:16:38]: Um in the 25 years I've been here and engaged in land use planning and management. And so with that, we've sat down with these landowners and said, look, we don't want the same the same typical development. And with that, we've we've worked together with land planning firm to come up with a a true concept of a mixed-use development. [0:16:38, 0:16:58]: Um, where we have vertical mix use as well as um restaurant opportunities, office opportunities, um, residential opportunities. Um what you see before you on this plan was back in 2010, the county engaged in a Liverpool Centers initiative study that was done for this whole entire area. [0:16:58, 0:17:14]: area and part of that plan re reflected what you see here on on the map to the right. Right. Um as we know that back then we were coming out of well still in a recession back then and the market has changed. [0:17:14, 0:17:17]: Uh and so that plan has changed to some degree. [0:17:17, 0:17:37]: But we recognize that some of the components in that plan are still useful. And with that in mind, we move forward with with a new concept. I will say that the multifamily that you see here will probably end up not getting built for the simple fact that I can't tell you who's potentially coming there, but there's a major entity. [0:17:37, 0:17:42]: That's coming there that would be a literal game changer for not just the city of Stockbridge, but for [0:17:43, 0:17:51]: Henry County as a whole and the South Side of Atlanta for the whole. Because in order for you to enjoy that venue, you literally have to go on the north side of Atlanta to get to it. [0:17:52, 0:18:12]: And I will leave it at that. Um but the other components of this are still very much in play. Um and this is something that obviously uh we've talked to Henry County about. They are very much engaged in this. This is the type of planning that I was hoping that would happen throughout the county at some point to slow down the mass development in the Hitherland. [0:18:12, 0:18:14]: Um [0:18:14, 0:18:34]: But a portion of this property to the south is still in the county. Um the owner of that pro portion of the development is actually going to be seeking annexation with the county is aware of. They've seen this plan, they have no problems with it, um, and should allow for that portion to come into the city. This will be a little different from what you see across the street on the southwest. [0:18:34, 0:18:54]: Portion of the interchange with the Bridges of Jotico. You have more dispersed use. Here it's a little bit more condensed. But pretty much not accomplishing this with a big box retail. There will be no big box retail here. There will be mom and pop shops with folks living above, restaurant up. [0:18:54, 0:19:14]: Opportunities and we are actually actively talking to restaurants. Um, a few of them you may know by name about locating as in portions of this development as well. So it's an ongoing process with us working um with the landowners and their reps to make this happen. Um and hopefully uh by the time I come back to you guys. [0:19:14, 0:19:27]: next month I will actually be able to name the entity that's actually coming on the top portion of this property. Okay. All right. And this is just for presentation. I'm here to ask any questions you may have. Okay. Um while you're there. Any questions from the board? [0:19:29, 0:19:29]: Mr. J. [0:19:30, 0:19:50]: Yeah, um thank you, Ms. Jackson, and thank you, City Manager, for the the report. Uh a few questions actually, but I know it's still in the planning process. So I just want to make sure one, I say this every meeting, just about, um I'm one thousand percent for bringing new development and bringing success for our city. Um but this is I definitely can say this is something that the young professionals [0:19:50, 0:19:57]: That we want to bring to the city will definitely come to. Um, but I have a few concerns and a few questions. Uh one is [0:19:58, 0:20:00]: Let me see how to say this right. [0:20:01, 0:20:12]: Um, is there a reason why this is still another like kinda sort of the similar project in district five? Like is there now no other district this can be done in around the city or? [0:20:12, 0:20:25]: So the answer to the question is where do you put density from a land use smart planning concept? You put it next to where the transportation network could support it, right? If I built this in Kellytown, it would be totally out of place. [0:20:25, 0:20:29]: Right, because there's nothing in Kellytown to support a development like this, right? [0:20:30, 0:20:32]: So most of the folks like you say it. [0:20:32, 0:20:35]: This development probably won't have me living in it, but who will it have? [0:20:35, 0:20:40]: My son, who's twenty three years old, that lives in a development just like this in Alexandria, Virginia. [0:20:41, 0:20:44]: Right, but he doesn't want to come home because those amenities don't exist here. [0:20:45, 0:20:53]: Right. Um, so yeah, this would be something that would attract him, pretty much in your generation. Right. Um, so this is not for me. [0:20:54, 0:20:58]: Right, when I leave this, it's gonna be either acreages or island. [0:20:58, 0:20:59]: I'm a boo. [0:20:59, 0:21:02]: Um outside of that, um [0:21:02, 0:21:11]: There is this is where you would want to put a density development. And if you go back to Henry County's zoning and land use plan, this is what you call a node. [0:21:12, 0:21:14]: So you have the density necessary. [0:21:15, 0:21:24]: But it's close to where you have our major arterial interstate interchange to allow for flow of traffic. So this is the best place to put it from a land use planning standpoint. [0:21:25, 0:21:45]: Okay. I'm gonna try to sum up my last my last questions all at one time. One, I saw on here the collaboration master plan coordination. Um, and this is a huge development. I don't see that there was any coordination or discussion with the school board about it. I mean it's it's literally directly close to the school. Hold on, not finished. I'm I'm gonna give you all of them at one time. Um one, the school the school board, because [0:21:44, 0:21:50]: Um traffic study, um also [0:21:51, 0:22:07]: Is there gonna be any type of road road expansion for that area? Um and then I I wanna say these are two retention ponds on the I wanna say north and kind of the southeastern western side of it. Are those retention ponds in the in the layout or w what is that on the side? [0:22:07, 0:22:10]: To to the north. Okay. So first question, B O E. [0:22:11, 0:22:31]: Um so no, the BOE, this hasn't been approved, so no, it hasn't gone to them and they don't review uh zoning nor the county zonings. Um they give reference in the as a determined to the impact. So what you see here are not three bedrooms. These are typically gonna be um for the above retail, probably one and two bedroom. [0:22:30, 0:22:34]: homes for the most part. Um you will have some town homes here. [0:22:35, 0:22:55]: Um, like I said, the apartments will probably go away or will go away and will not be developed as part of this if that entity um when I can disclose who it is, w when you find out who it is, they won't that those apartments will go away. So as it relates to impact on the school should not be any different than [0:22:54, 0:23:14]: Um the development that's 100% rental a half a mile down the street from this, um, or what's happening at the bridges of Jodeco for the most part. As it relates to traffic study, um, there's already been traffic study done. As you see on this plan, you have a four-lane divided. [0:23:14, 0:23:16]: [1396.6, 1401.3]: Um right now if you're on Patrick Henry and you're going from Jodico to Eagles Landing. [0:23:21, 0:23:27]: The lanes that you see that are northbound and southbound are actually the northbound road. [0:23:27, 0:23:34]: up to Eagles Landing. Um both the city and the county have put monies towards the um [0:23:35, 0:23:55]: This engineering and design work as it relates to the other additional lane that needs to come through. The right-of-way exists for pretty much ninety-five percent of the roadway. Um the bridge will have to be replaced, obviously. Um and also um so and the developer would also put in part of the cost to make those road improvements or bond. [0:23:55, 0:24:10]: for in lieu thereof. I will say that um like I said this is a collaborative we understand that this road is going to be improved. This development obviously won't get built in one year. This is going to be a multi-year project. [0:24:10, 0:24:23]: Uh and so the road construction will coincide with the development. Um our goal is to have Splus Two be the actual development um for the northbound lane, well the southbound lane, two lanes when it comes through. [0:24:25, 0:24:35]: And that's what's planned for for Patrick Henry. So right now it's in uh SPLOS six to do the engineering and design. It'll be in T Splos two. [0:24:35, 0:24:42]: for development and the replacement of the bridge, which still needs to be replaced regardless if this get the road gets foreigned. [0:24:46, 0:24:48]: Mr. President, may I speak? [0:24:49, 0:24:51]: Mr. Chair. Mr. Tibbell. [0:24:52, 0:24:57]: Uh at one time that area was supposed to be a overlay district of high rise buildings. [0:24:57, 0:25:03]: I noticed when I was reading they said they didn't have any other plans about that area. I know for a fact. [0:25:04, 0:25:07]: that that area was supposed to have been a high rise office building at one time. [0:25:08, 0:25:11]: Could you explain to the ordin the audience? [0:25:12, 0:25:14]: What is a actual overlay district for? [0:25:15, 0:25:15]: Okay. [0:25:16, 0:25:22]: So an overlay district is literally you have your base zoning which may be residential or commercial. [0:25:23, 0:25:36]: Um, an overlay is what you put more additional restrictions on top of which you see without actually adding it to the base zoning, the underlying zoning. So those regulations usually include architectural design, landscaping. [0:25:36, 0:25:51]: Um they could control additional uses as part of the overlay district or restrict certain types of uses as part of the overlay district. So it's just another layer of development re regulations on top of what's existing already. [0:25:52, 0:25:54]: And that's why they call it an ovally. [0:25:58, 0:26:07]: And yes, um the original plan had, as you see in the 2010 plan, had more office. As you know, COVID has changed the way of life as it relates to office. [0:26:07, 0:26:08]: Um [0:26:08, 0:26:20]: A lot of office space are now sitting vacant, Goax, Dunwoody and Sandy Springs, would their tax base gonna be impacted by vacant office buildings? Um, and they actually [0:26:20, 0:26:29]: had a article in the Atlanta Journal Constitution about the negative impacts on vacant office space that is gonna be impacting Sandy Springs and Dunwoody. [0:26:30, 0:26:31]: Um over the next year or two. [0:26:32, 0:26:36]: Um because not a lot of companies are now allowing their employees hybrid schedules. [0:26:36, 0:26:38]: А лот вам увольки 100%. [0:26:39, 0:26:52]: Um and so that's why the office you see there's been a downplay in office. Yes. Ten years ago I would have told you that this area was ripe for office development, or fifteen years ago, um that reality has changed a little bit. [0:26:55, 0:26:58]: All right, thank you. Any other questions from the board? [0:26:58, 0:26:59]: Yes, Mr. Plant. [0:26:59, 0:27:05]: I just have a question. Is it uh correct to assume that all this property is currently annexed into the city of Stockbridge? [0:27:05, 0:27:10]: All except um the portion below Holloway. [0:27:10, 0:27:13]: adjacent between Holloway and Jodoko. [0:27:13, 0:27:25]: It's not. It's recently been purchased by Mr. Patel. Mr. Patel is on board with this plan and will be annexing in his property within the near future. So all of it will eventually be in the city. [0:27:34, 0:27:35]: Anyone else? [0:27:37, 0:27:42]: I do need to ask, as we will not be voting on this tonight, do we open for public debate? [0:27:58, 0:28:03]: I think it's only fair. So I will ask if you would like to comment if you are for [0:28:04, 0:28:20]: Please line up to my right or your left. Make sure you sign in. If you are against, please line up to my left or your right. When you approach the podium, please make sure you state your name, state your address. Um speak into the microphone, please. [0:28:29, 0:28:49]: Good evening. Before you start the clock, your Anthony, correct? I am. Your name tag is No, that's okay. It was I was just kept wondering what was who was who. Sorry. Thank you. My name is Ann Fields. Um, just to speak briefly on the Patrick Henry Parkway development. [0:28:49, 0:28:50]: Okay. [0:28:51, 0:29:01]: Those of us that live in Eagles Crest, which is across the street from this development, the houses um that are in the existing development, which you can see. [0:29:01, 0:29:20]: the existing development is below the hospital. So all those homes that are on the right side of the the development proposed on the screen, those existing homes is Eagles Crest. So um I live there, I'm house number eight on Chase Marion Way. [0:29:20, 0:29:21]: And um [0:29:22, 0:29:25]: There's a I know the developments are gonna happen. [0:29:26, 0:29:46]: The 77 and 87 Holloway, I want to bring this up first because I'm sitting here with my jaw dropped. I opened a Publix Records request to get a copy of the finalized plan for that. It was closed, stating it was not prepared. However, during Main Street or the other daytime public meetings. [0:29:46, 0:29:52]: Meetings, one of the councilmen had said that plan was ready months ago in March and during the March meeting. [0:29:52, 0:30:03]: I have yet to see a finalized development plan for seventy seven eighty seven. And what is on the screen is not what was sent to us, is not what was discussed, is not what council voted on. [0:30:03, 0:30:20]: So now I'm even more concerned with what I'm gonna say about this. Num point number one being the entrances and exits of anything you build along Patrick Henry have to be considered very seriously. The Department of G D O T [0:30:21, 0:30:22]: has already stated [0:30:22, 0:30:23]: Excuse me. [0:30:24, 0:30:44]: Has already stated that they will not allow entrance and exit from Jodico because of the I-75 ramp. So immediately any property that is below the hallway down to Jodico could be developed, but you're pushing those people down in and then back out. [0:30:44, 0:31:04]: And we're very, very concerned about the Holloway intersection. I tried my hardest during the SPLOST meetings to get a roundabout considered for Holloway and uh Patrick Henry. That may end up as part of the overall development plan for the widening of the [0:31:04, 0:31:24]: The road, but it was not a separate consideration. Any traffic studies being done need to be done during the school year period, because the traffic to and from the school, morning and afternoon, is abominable and it's horribly dangerous. Entering and exiting hallway on [0:31:24, 0:31:31]: To Patrick Henry because of school traffic and the traffic that's already perusing Patrick Henry. [0:31:31, 0:31:39]: We haven't seen the worst of the traffic here because Costco development bridges is nowhere near done. That is going to [0:31:40, 0:32:00]: Probably quadruple or more the volume of traffic on Patrick Henry alone. All of those things need please need considered. We don't need to lose anyone's life, especially someone with a child in their car. Contingent upon any right-of-way for any development should be the fact that that land be donated for [0:32:00, 0:32:04]: for the widening of Patrick Henry if it already hasn't been acquired. [0:32:05, 0:32:25]: Um that would save any millions of dollars to go towards construction, um, design and construction from the SPLOST and T SPLOST funds. Um if you're going to approve multi-use and mixed use, you were just mentioning taking out the apartments as part of closing the first phase of this deal. [0:32:25, 0:32:45]: So that's kind of a big concern. If we're staying with mixed-use, multi-use, shouldn't we stick to that master plan? I'm very concerned about noise, fire protection, insects, and rodents, as they are paramount to our physical and mental health. And so we would want to have noise barriers, fire. [0:32:45, 0:33:05]: protection, proper placement of between buildings, um, all of those adequate things that won't drive one building to catch another on fire, and of course, insect control. And um as I mentioned, that property that's below hall um below Holloway has no exit onto Jodico. So [0:33:05, 0:33:09]: Please plan entrance and exit into this plan very, very carefully. Thank you. [0:33:10, 0:33:10]: Thank you. [0:33:16, 0:33:36]: My name's Connie Snow and I live at 426 Chase Marion Way. I also live in the Eagles Crest Subdivision and I second everything that Ann said. When we had meetings about this months ago, I'd brought up the school systems. We sit directly in front of Eagles Landing High School, Eagles Landing Middle School, and not very far from Flippin' Elementary. In fact, most [0:33:36, 0:33:53]: Most schools or most kids in the Eagles Landing Middle and High School walk to and from their homes that live in that area. So then we're gonna put all these extra apartments and homes right around that area where obviously those kids are gonna attend that school because it is in close walking distance. [0:33:53, 0:34:13]: And they're probably gonna walk because that's just what they're gonna do. That's what young teenage kids and middle school kids do, right? That road's not set up for'em. They're all gonna get hit. We're gonna have so many kids they're gonna be hit by cars because we're not planning proper uh properly. Additionally, there's so much little water resources and streams around the area. My neighborhood's already [0:34:13, 0:34:33]: Are already constantly flooding with the creek source that's right behind Eagles Landing High School. It floods quite a lot, so much so that my property is eradicating rapidly. The moment you guys keep cut cutting down these trees, that water's just gonna start flooding. And it's not only gonna flood Eagles Crest, it's gonna flood the surrounding homes around that area. It's gonna start [0:34:33, 0:34:45]: start to breach out across Jodeco and those homes over there. And it's eventually going to impact the Eagles Landing High School and Middle School area and their football fields. It's all going to be damped and wet and damaged. [0:34:45, 0:34:56]: It's not a properly planned development. And to piggyback off what Ann said, the renderings that we were given for both Patrick Henry and Holloway look drastically different than they do today. [0:34:57, 0:35:09]: It was listed on the site that the property owners were contacted. We were contacted months ago when this first started. But as we can all tell today, what we talked about and what we even disagreed on. [0:35:10, 0:35:17]: hasn't it it's been made differently, it's changed rapidly, and none of us have been consulted. And that's not fair to us as a community. [0:35:17, 0:35:37]: When I was here months ago and I brought up the school system to the mayor and the city council, and I told them that I was not only worried about the danger of our kids walking, I was worried about the increased crime rate. There's been multiple shootings in my neighborhood. Again, I sit directly behind the high school football field, so much so that the kids can walk. [0:35:37, 0:35:38]: From the football build. [0:35:38, 0:35:42]: through the the property that the school homes and ended up in my backyard. [0:35:43, 0:36:03]: We've had multiple shootings. The crime is gonna get so much worse. Our infrastructure is so poorly planned right now. This is not a good place for it. Because at the end of the day, while the businesses are getting rich and we think we're solving this shortage of homes, all we're doing is cramming stuff in in areas where it's poorly planned and it doesn't belong. [0:36:03, 0:36:03]: Okay. [0:36:04, 0:36:18]: This development does not belong here. This development will cause us to be terrible of our. And I beg of you to please do whatever you can to stop it. We deserve better in this county and whatever you guys can do to do what's right, not just for me. [0:36:19, 0:36:23]: But for our kids, because at the end of the day, the ultimate impact from that development. [0:36:23, 0:36:39]: is going to be our children. And there's not one person that sits on this board or the city that could deny that. The mayor told me at the last meeting that while he cared about kids, those two schools set on county property and it wasn't the city's problem. That was his exact words. [0:36:41, 0:36:43]: At what point do we care? Thank you. [0:36:44, 0:36:44]: Thank you. [0:36:53, 0:37:07]: I'm gonna just sit this on here. Hey y'all. Uh I was not really prepared to come, but then I saw the uh agenda for tonight, so I wanted to come. My name is Tina Corey and I live at 660 Chambers Road in McDonough, Georgia. [0:37:07, 0:37:11]: I've been a resident here for thirty five years and I'm the founder of Conserve Henry. [0:37:11, 0:37:15]: And I just wanted to point out a few things and I see a lot of friendly faces there, but [0:37:16, 0:37:18]: One of the things that I wanted to [0:37:18, 0:37:21]: to kind of share with you all is is the fact that [0:37:21, 0:37:29]: When you're looking at your future land use map and you see where we're gonna go and that's gonna be the future, a lot of things need to be taken into consideration. [0:37:29, 0:37:34]: And I know most of you probably had breakfast this morning. I know I did. I had bacon and eggs. [0:37:34, 0:37:54]: Next time that you look at a plate of bacon and eggs, I want you to think of two things. I want you to remember that for the chicken, that was a day's work. For the pig, that was a lifetime commitment. So when these things come up, and this is a result of um ARC and TSW, which is their planners, along with SB 612 that created. [0:37:54, 0:37:55]: Yeah. [0:37:55, 0:37:58]: Uh, when you look at that I want you to remember that for the [0:37:59, 0:38:11]: Developers and their attorneys, this is a day's work. They don't live here and they're not invested. For us here in the community, we live here, we're gonna stay here, we're invested here, and that's the commitment that's gonna be made for us to endure. [0:38:12, 0:38:26]: A couple of things I wanted to raise with you all is number one, I'll be perfectly honest with you. I'm really disappointed that there's nobody up there on that board that looks like me. Nobody on that board that looks like me. And that that's kind of a little [0:38:27, 0:38:29]: disconcerting that it's an all male board. [0:38:29, 0:38:36]: And nobody there to look out for family and children issues, nobody there to look out for racial racial and social issues. [0:38:36, 0:38:39]: Or conservation and education. [0:38:39, 0:38:42]: problems that we have right now in h in Henry County that I am [0:38:42, 0:38:43]: So in [0:38:43, 0:38:44]: You know, just [0:38:45, 0:38:45]: worried [0:38:46, 0:38:50]: Абин вот words can actually express is our schools and our education. [0:38:50, 0:39:09]: If you remember, hi uh uh Clayton County lost its accreditation. It took them several years to get their accreditation back. We are on that path now. These are the same developers from Clayton County that are now pushing what they want to push here, more apartments, more this, more that, while we have failing schools, and if we don't [0:39:09, 0:39:13]: Wake up and do something, we're gonna be going down that path. [0:39:13, 0:39:16]: And and all you have to do is turn on the paper and look at the news. [0:39:16, 0:39:22]: Also, I'm here because I have a nephew that was murdered in Hampton. His name is Fernando Rodriguez. [0:39:23, 0:39:26]: And that happened in twenty nineteen, and we've been waiting for justice for that. [0:39:26, 0:39:30]: We have a lot of issues in this county that need to be [0:39:30, 0:39:39]: taken into consideration and we need to start looking at collaborations and things like when you said you left out the education. I we should have an intergovernmental [0:39:39, 0:39:45]: relationship with all of the other agencies and especially with our children and family side of it that [0:39:46, 0:39:50]: You know, education not being the forefront and all these decisions made. [0:39:50, 0:39:53]: And I'm sorry, no more apartments. So back in the day [0:39:53, 0:39:54]: When [0:39:54, 0:39:59]: My children were little. I have four children that are grown and and three of them live here in Henry County. [0:39:59, 0:40:03]: Ан, а сев гранки. [0:40:03, 0:40:07]: So back in the day, our problem was I live on the other side of the interstate. [0:40:08, 0:40:14]: I worked so hard to get funding in the department of transportation for Henry County, for Jonesboro Road and for [0:40:15, 0:40:26]: Jodico Road because our problem was we had emergencies. We could not even get over to the hospital. So now now that we finally have some openings to be able to get to the hospital, and that's the only hospital that serves our county. [0:40:27, 0:40:31]: Наю блок, автор авtried со хар то опену апат то геть. [0:40:31, 0:40:42]: So that I have a son that's type one juvenile diabetic. We have other issues. I have aging parents or grandparents uh that were living with me at the time and you know that was a big concern. So [0:40:43, 0:41:02]: Pl please just, you know, I'm not saying anything about this development completely, but we're a family. We're all Henry County. And your land use map impacts Henry County's land use map and Hampton's land use map. And we just need to start to come together and start thinking about conserving Henry to make it better for those that are coming behind us. And I know that my children [0:41:02, 0:41:17]: want to stay here for a good county, but they don't want to stay here for a county that doesn't care about education. Who wants to put their kids in a failing school? So again, thank you. Look at SB six twelve. You'll see who benefits from that. And it's not the citizens of Henry County. Thank you. Thank you. [0:41:25, 0:41:37]: So as this was a city presentation and update, I did not ask if there was anyone from TSW consulting. So I'm going to make the assumption no one is here. So you went to Rabut or uh make any comments? You said from where? From the uh consulting group. [0:41:37, 0:41:57]: No, the consulting group was was hired by this by the city to do the work. They didn't propagate this on their own. This was something that they was asked to work in with us and connected with the landowners to come up with a master plan for the area, right? Um, so someone said that this is different from the plan that was. [0:41:57, 0:42:02]: approved. So I assume that everybody's getting this mix up with the piece of property that uh [0:42:03, 0:42:19]: pretty much wrap adjacent to um where Miss um Connie um lives, um which is that triangular piece. Um if you could see it on here, which is this. This is not included in this project. That's already been rezoned. [0:42:19, 0:42:24]: Um council resumed that last year. That's not part of this project. [0:42:24, 0:42:32]: Um so no, this is different from that. It's not the same thing that we changed it. I think that's a little confusing there. That's not the same thing. [0:42:32, 0:42:35]: Um, I do agree. Um [0:42:36, 0:42:40]: I have an eleven year old just left uh flipping elementary and is now at [0:42:41, 0:42:45]: Eagles Landing Middle School um as a sixth grader. [0:42:45, 0:42:50]: Uh my son attended Eagles Landon High School and Dutchtown High School and Dutchtown Middle School. [0:42:50, 0:42:52]: Um so I get it. [0:42:52, 0:42:55]: I'm vested here too, twenty five years in. [0:42:55, 0:42:59]: Um and my kids have gone through the school system and are going through the system. [0:43:00, 0:43:20]: Uh and so I understand the concerns and thank you, Victoria. I don't know if you remember me, but I remember when you were fighting for bike lanes in the county when I first got here. Um so yes, ma'am. So um and she knows we used to ask to put those as conditions on Zona and got them denied by the order of commissioners years ago. Um and unfortunately. [0:43:20, 0:43:28]: Unfortunate the work that she did, especially on Jodeco Road, where we have the bike lanes, they're now gone, unfortunate. You can't see them. Um [0:43:28, 0:43:39]: Right. Um, but we still have folks to traverse. So yes, um as it relates to um Costco having the impact and the traffic impact, I agree um that yes, [0:43:39, 0:43:45]: That intersection because I go that way once I leave Eaglesland in middle school. I come down and then I turn north on that road. [0:43:47, 0:43:51]: And yes, the traffic is you know it is bad. The school's traffic is bad on [0:43:52, 0:44:01]: tunest to begin with. Um, because you got people that don't adhere to the rules. Um, but as it relates to a traffic relief, I want everybody to remember that there is a [0:44:02, 0:44:07]: Western parallel connected, it will go from Hudson Bridge down to Jodeco Road. [0:44:07, 0:44:13]: Um one portion of that Chin Parkway is already constructed and the state is working on [0:44:14, 0:44:26]: getting the portion between Jodoko Road back to Hudson Bridge. If you haven't don't know where that is, if you go to Walmart right there at the McDonalds, [0:44:26, 0:44:38]: The Four Lean Road that just dead ends at the back of McDonald's, that's the road that's actually going to push all the way down to Jo to Jo Jonesboro Road. So there will be a western parallel um [0:44:39, 0:44:44]: that's coming through that would obviously believe and that start that phase starts construction I think next month. [0:44:45, 0:44:47]: Um so that'll be on the way. [0:44:47, 0:44:53]: So that'll be some relief so you won't have a lot of traffic coming directly to Costco from that area, they'll come down on the other side. [0:44:54, 0:44:54]: Um [0:44:55, 0:45:15]: Yes, we need to look at the intersection and that's something that I think she mentioned about a roundabout and yeah, and that would be helpful if we could make that work. Definitely I think it makes sense, um, as part of the deal. Um, no, there is no access point uh that we've looked at because it doesn't make any sense to put a access point between [0:45:15, 0:45:19]: The northbound interchange and Jo and Patrick Henry on Jodeco. [0:45:20, 0:45:21]: G Dot won't approve one. [0:45:22, 0:45:27]: Um and it doesn't make any sense because at that point where this property is, it's the actual [0:45:27, 0:45:34]: taper lane to get onto the interstate from there and that doesn't make any sense to put traffic going there because the only place you could go is on the interstate. [0:45:35, 0:45:51]: So no one's that's bad transportation planning. I think if you look clearly at what we propose here, a lot of uh you know, and this isn't the final it'll hopefully be the won't be the final, but a lot of interior movements to allow for a lot of the traffic to stay inside. Um, as it relates to students walk into school. [0:45:52, 0:45:55]: I don't know how many kids are gonna walk a mile. [0:45:55, 0:46:07]: Um literally from this product pr development down Patrick Henry down up Holloway and up Tunis. Um they're probably gonna catch a bus for the kids that are actually coming out of here. Um [0:46:09, 0:46:29]: Because there are some kids that do walk and I see them in the morning, um, that live on Tunis and some that live on Holloway. Some of the older kids. Um, as it relates to ARC, um, pushing this, um I've been a cine planner for almost thirty five years, um, also certified. [0:46:29, 0:46:34]: nationally through the American Institute of Certified Planners. This is something we call [0:46:35, 0:46:37]: Good planning for the standpoint of [0:46:38, 0:46:43]: We offset development going out more into Kelly town, where we do have. [0:46:43, 0:46:46]: environ more way more environmentally sensitive areas. [0:46:47, 0:46:47]: Um [0:46:48, 0:46:49]: Right. Um [0:46:49, 0:47:00]: by allowing this to happen and not to be spreading out at one acre lots or three quarter acre lots. And I always tell folks if you pull back on the Google Earth and look at Henry County. [0:47:01, 0:47:05]: Alright, all you see is single family developments everywhere. [0:47:06, 0:47:10]: Right. And if you move to Henry County like I did in two thousand? [0:47:10, 0:47:12]: I was part of the problem. [0:47:13, 0:47:14]: Why? [0:47:14, 0:47:17]: Henry County started growing in nineteen ninety four. [0:47:18, 0:47:19]: We've got a lot of developments coming in. [0:47:20, 0:47:23]: The crust of that started when they built Eagles Landing Country Club. [0:47:24, 0:47:26]: I'd put Henry County on the map. Since then, she's right. [0:47:27, 0:47:30]: А ремонта ту ленс от Его'на День. А до ремонта ту ленс. [0:47:31, 0:47:36]: Across the interstate at Jodico Road. I do remember the two lanes at Jonesboro Road. [0:47:36, 0:47:43]: Right. Um, I was here for that, and I was here watching ambulance having to go up on the sidewalk to go around cars because it was only two lanes. [0:47:44, 0:47:44]: Um [0:47:45, 0:47:51]: I was here when twenty eighty one was improved and now it's improved again. It's a diverging diamond. So in the last twenty five years. [0:47:51, 0:47:53]: I watched that roadway change twice. [0:47:54, 0:48:10]: Right. Um and now we're proposing another interchange down at Bethlehem Road. So yes, unfortunate. Um unlike Texas, Georgia doesn't allow for the infrastructure to be built ahead of time with nothing on it. We tend to be lagging behind. [0:48:11, 0:48:12]: Um I literally spent [0:48:13, 0:48:33]: a week in Dallas metro area and was wondering where all these roads go to because there was nothing on'em. Um and then the guy painted the picture for me that this is come what's coming will come to this and we won't have to retroactively fix it. I wish we could get to that point. Um but unfortunately we've lagged behind, schools have lagged behind here as well. Um [0:48:34, 0:48:36]: As a release to noise and fire protection. [0:48:37, 0:48:42]: You know, anything that's built has to be built to code. That code is controlled by um [0:48:42, 0:49:00]: International Code Congress, which is adopted by the Department of Community Affairs and all adop all associated communities adopt the ICC building and property maintenance codes um and fire protection codes. We have to adhere to those. Um so we can't bill without adhering to those standards. Um [0:49:00, 0:49:20]: The right-of-patrick Henry already exists for the most part, as I mentioned. 90% of that is already in place. Um and hopefully, yes, we're as we work with the development, the goal is to offset the cost on the impact on this plus by allowing the developer to put in at least 50% of the costs towards the road improvement. That way, Henry County. [0:49:20, 0:49:23]: And Stockbridge only puts in twenty five twenty five. [0:49:23, 0:49:41]: Plus there's fifty equals a hundred percent. Uh and that's discussions that'll be ongoing as we go through the process. Um I think that was some of the concerns on the infrastructure addressed at schools. Um obviously, you know, the quality our schools, and I always say this. [0:49:41, 0:49:45]: I actually spent two years being a school teacher after gradu undergraduate school. [0:49:46, 0:49:49]: Failing schools are dependent on failing parents. [0:49:50, 0:49:50]: Period. [0:49:52, 0:49:54]: Right. I remember working in the city of Griffin. [0:49:55, 0:49:56]: as their development director. [0:49:57, 0:50:06]: And people did not want their kids to go to Griffin High School. But you know what's one of the number one schools for putting kids in the service academy of the United States of America? [0:50:07, 0:50:07]: Griffin High School. [0:50:08, 0:50:11]: So explain to me how those kids can literally [0:50:11, 0:50:16]: Get the GPA and the necessary academic skills to qualify to go to. [0:50:17, 0:50:19]: The Air Force Academy, West Point. [0:50:19, 0:50:20]: The Naval Academy. [0:50:21, 0:50:22]: Coming from a failing school. [0:50:23, 0:50:25]: Failing kids are because of failing parents. [0:50:26, 0:50:27]: Period. [0:50:28, 0:50:37]: I'm a parent of two. My fourteen year old, when he was fourteen, he's now twenty-three, did not go outside at night. I know exactly where he was. My eleven year old does not traverse around the street. [0:50:38, 0:50:40]: Because I'm a concerned parent. [0:50:41, 0:50:58]: Right. So I think we need to put the onus where it is. So on poor parenting or poor parents. Um so if you put it in, your kid could go to any failing school and still succeed. You know why? Because if you put the time into your kid and your kid put the time into the work, they'll succeed. [0:50:59, 0:50:59]: Right. [0:50:59, 0:51:00]: Um I'm a product of that. [0:51:02, 0:51:03]: So I could speak to that. [0:51:03, 0:51:10]: And I think my kid could speak to that, who finished Wesleyan University and now working for a major firm in the Washington DC area. [0:51:10, 0:51:11]: Graduated from Eagles Landing High School. [0:51:12, 0:51:13]: Twenty eighteen. [0:51:14, 0:51:16]: got an appointment to United States Naval Academy. [0:51:18, 0:51:19]: But chose to play soccer. [0:51:19, 0:51:21]: At a small school in North Carolina. [0:51:21, 0:51:22]: Right. [0:51:22, 0:51:23]: Came from Eagles Line High School. [0:51:24, 0:51:24]: So [0:51:25, 0:51:28]: What you put into your kids is what you get out. You put zero, you get zero out. [0:51:29, 0:51:33]: Um, development don't control educational attainment. Never has. [0:51:33, 0:51:38]: Um, but we still have to look at that, right? Um, and account for it. [0:51:39, 0:51:59]: So this is still in the planning stage. Um we're working, hopefully like I said, this is not for you guys to vote on tonight. Our goal is to kind of give you guys what's coming. We did this presentation before the um city council back in November. Um we presented this to um the board of commissioners, uh some of the board and the staff to review. [0:51:59, 0:52:13]: and got their feedback. Um and so with that not asking for a vote and we'll make the necessary changes, we'll address some of the concerns. Um because I do know that that intersection is a concern that Holloway and at Holloway and um [0:52:14, 0:52:20]: And Patrick Henry, as well as Holloway and Tunis, which is a bad left hand turn. [0:52:21, 0:52:30]: if you go into the schools. Um and so at that I will end and uh we'll make uh keep these comments so we'll make necessary changes as and then [0:52:30, 0:52:36]: At some point we'll bring bringing this back to the planning commission um to actually take action on and take more comments. [0:52:37, 0:52:38]: All right, thank you, sir. Appreciate it. [0:52:39, 0:52:47]: Okay. As this is a non voting item, we've got a lot of ground to cover. Um unless the board has anything else they'd like to ask, I think we'll we'll move on. [0:52:50, 0:52:56]: Okay. Ms. Logan, could you repeat item two for me again? You made a comment earlier, it's been a while. [0:53:01, 0:53:13]: Two, um it was adoption of new land use and zoning maps for City of Stockbridge. The planning and zoning office needs um needs to conduct further research on this. [0:53:14, 0:53:19]: Okay, understood. Did we require a vote to pass on this? [0:53:25, 0:53:27]: and two it was advertised for [0:53:29, 0:53:30]: Yeah. [0:53:31, 0:53:31]: Mm-hmm. [0:53:33, 0:53:34]: We do. I think. [0:53:41, 0:53:41]: Okay. [0:53:45, 0:53:51]: No, no, I think we can if we can pass. That's what we can do. We want to remove it from tonight's agenda. [0:53:52, 0:53:57]: Okay. Do I have a motion from uh the board to remove from the agenda? [0:53:58, 0:54:09]: Chair. Motion to move item number two adoption of the new the new land use and zoning maps for the city of Stockbridge to uh for a meeting in in the future. [0:54:09, 0:54:16]: I'll second it to Harrell. Okay. All in favor? Aye. Aye. Aye. Motion passes. [0:54:23, 0:54:30]: Okay, the next case is CP two zero two four four four four four zero one. I'll read this into the record. This is council district five. [0:54:30, 0:54:50]: Consideration of a comprehensive plan amendment request to change the future land use designation of property on the north side of Hudson Bridge Drive, comprising parcel zero three two dash zero one zero two six zero zero zero from medium density mixed use to medium density residential to allow for the construction of a townhome development. And then tracks one and two were further subdivided on February fourth, twenty twenty four, which created a new tract, and that became Walmart. The real t the track two would become a standalone [0:57:52, 0:58:12]: Parcel for future development. The master development plan initially allowed the subject sites to have access from Hudson Bridge Road, but the art parcels were later created and this removed the site access to Hudson Bridge Road. A DRI was completed on the master development plan, including the subject site on November twenty first, twenty two. [0:58:12, 0:58:30]: two thousand three and a development agreement was prepared. And according to the DRI, the site shall be mixed use and contain a minimum of two hundred residential units and a maximum of three hundred and forty three thousand square feet of commercial retail space. However, DRI officials stated that DRI conditions have no effect after ten years. [0:58:33, 0:58:53]: In addition, there was a partial split with the East Mint creation, and that was by Wolverton and Associates of Duluth, Georgia. And that was part of the final subdivision plat for uh the Broad Street Stockbridge LLC. It showed that the subject property, which is shown here, was split into two tracks with track one representing the conversation. [0:58:53, 0:59:13]: Current boundaries of site and track two being cut off from the site. This resulted in track one using this access from Hudson Bridge Drive. However, ten easements were created along and adjacent to Hudson Bridge Drive, which included an easement to allow a portion of Hudson Drive, which is a private street, and which is actually contained within the boundaries of the subject site to be used. [0:59:13, 0:59:16]: by the public for access to the surrounding commercial properties. [0:59:18, 0:59:25]: And it says the Hudson Bridge Drive is located within the site boundaries. The current land use designation of medium density is compatible with the applicant's requested result. [1:01:59, 1:02:08]: Of the property to MFR. And in addition, the current landing destination of medium mix is incompatible with the applicant's request resulting of the property, MFR. [1:02:10, 1:02:13]: And this is the future land use map. The [1:02:15, 1:02:21]: The area is surrounded by medium density on the left side, which is Henry County, high density mixed use. [1:02:22, 1:02:27]: Which is over here, and high density residential, which is down here, with in in orange. [1:02:30, 1:02:33]: And these are the surrounding land use designations as mentioned. [1:02:34, 1:02:54]: You have property to the north, which is St. Ives, high density residential, along with the St. Margaret subdivisions, and you have property to the south, which is medium density mixed use, and high density residential for the Hudson Bridge townhomes. [1:02:54, 1:03:00]: Subdivision, medium density residential, and along with the Oakwood Manor Subdivision, which is also medium density residential. Therefore the six point seven eight six point eight seven units per acre is acceptable. [1:03:18, 1:03:38]: And the key points from the staff analysis is that it's consistent with the current comp plan, 24 to 28 comp plan, and will be compatible with the MDR MDR medium density residential, which is the Oakwood Manor Subdivision. And it's unlikely that the type of uses on the current medium density mixed. [1:03:38, 1:03:39]: This will be developed. [1:03:44, 1:03:48]: And staff recommends approval for the comp plan. C P twenty four dash zero one. [1:03:54, 1:04:14]: Gordon, before you go on, let me go ahead and read the rezoning into the record, please. So that's item four on everyone's uh notes here. So this is RZ-2024-01. Rezoning case, RZ two zero two four zero one to be located in council district five. Consideration of requests to rezone the property on the north side of [1:04:14, 1:04:22]: Heights and Bridge Drive comprising parcel zero three two dash zero. Variance request number one, consideration of a variance request for two variances on property on the north side of Hudson Bridge Drive, comprising parcel number 032-010-2600 to allow for the construction of a townhome development. [1:05:31, 1:05:41]: Variance request number one would reduce the front yard setbacks of the townhome lots from the required fifty feet to twenty feet. The property also lies within the PMU. [1:05:42, 1:05:56]: which is the uh Parkway Mixed Use Overlay District. The applicant again is Lanier Georgia. LLC Asian is Battle Law PC. The property again is located in landlot twenty-one of district six and contains twenty point three six seven acres. [1:05:58, 1:06:02]: All right. Thank you. Okay. Go ahead. Thank you. All right. [1:06:07, 1:06:09]: So item number [1:06:12, 1:06:13]: Shall we read six? [1:06:13, 1:06:14]: Okay. [1:06:16, 1:06:36]: Item six is also variance, variance case VR two zero two four-zero three to be located in Council District Five. Variance request number two, consideration of a variance request for two variances on property on the north side of Hutchin Bridge Drive comprising parcel number zero three two-one zero. [1:06:36, 1:06:56]: 26000 to allow for the construction of a townhome development. Variants request number two would reduce the side yard setbacks of the townhome lots between buildings from the required 15 to 10 feet. The property also lies within the PMU Parkway Mixed Use Overlay District. The applicant again is Lanier Georgia. LLC, the agent is Battle Law PC. [1:06:56, 1:07:02]: The property is located in landlot twenty-one of District Six and contains twenty point three six seven acres. [1:07:04, 1:07:05]: Thank you. Thank you. [1:07:07, 1:07:10]: So this is the presentation for R Z twenty four dash zero one. [1:07:12, 1:07:22]: With the applicants applicants request to rezone the property from C two, General Commercial, to MFR to allow for the townhome development with one hundred and forty units. [1:07:25, 1:07:31]: So this is the twenty-four um the zoning map. The area is surrounded by C two. [1:07:33, 1:07:43]: C three, MFR, which is the St. Ives, and the Hudson Bridge Townhomes, RM, which is residential multifamily, the Oakwood subdivision, [1:07:44, 1:07:50]: Manor and R D Residential Duplex, which is also the Oqu Oak Manor. [1:07:55, 1:07:59]: And this is the overlay district map which shows the property being located in it. [1:08:03, 1:08:23]: And the key points from the staff report that we analyzed. Um overall it's consistent with the twenty point four comp plan. And as far as the positive effects, um the business in the surrounding area could generate revenue from the townhome development. Residents will have convenient access to the adjacent commercial areas. [1:08:26, 1:08:43]: A twenty five foot buffer, fence, and tall trees shall be provided along the western property line to prevent the Oakwood Manor Subdivision and a secondary access at the northwest corner onto Oakwood Drive should be used for emergency access only with a lock gate. [1:08:45, 1:08:50]: And that water could be made available with sewer line extension, which the developer would need to fund. [1:08:58, 1:09:18]: And staff staff recommends approve approval with conditions for RC twenty-four-zero one. The first one is the comprehensive plan amendment. The requested this requested resilience shall not be approved unless the applicant requested comprehensive plan via 24-01 to change the subject property. [1:11:42, 1:11:47]: Wood Manor Subdivision along with the installation of a fence and tall trees. [1:11:49, 1:12:00]: Three, one car garage townhome units. A. Only twenty percent of the townhome units shall have one car garages. B all one car garages shall have full brick elevations. [1:12:01, 1:12:21]: Four, external sidewalk. And eight, a townhomes association shall be established or a property management company shall be secured for the purpose of maintaining all common areas of the site. [1:13:08, 1:13:12]: And this is the presentation for VR twenty four Dash Zero three. [1:13:14, 1:13:31]: The applicant has submitted a variance application to request a reduction in the front yard setbacks of the townhome lots from the MFR's district required fifty feet to twenty feet, and to reduce the side yard setbacks between townhome buildings from the required twenty feet to ten feet. [1:13:34, 1:13:43]: So the required versus the proposed setbacks and the request is MFR districts. So these are the MFR setback requirements, which you can see on the left side. [1:13:45, 1:14:00]: And the proposed setbacks, which is in the front yard setback and the side yard setback, and was the rear yard setback. So the front yard setback does not meet the MFR requirements along with with the side yard setbacks, while the rear yard setback does. [1:14:05, 1:14:05]: Let's see. [1:14:11, 1:14:17]: And the staff analysis. So section ten point one three of the Union Development Code for variance request one. [1:14:23, 1:14:38]: So the as far as the quest for the first one, the property the key points from the staff analysis was that the property has a unique shape with creek wetlands and a large drop off in the southeast, which makes the areas unbuildable, resulting in the fewer proposed units. [1:14:40, 1:14:52]: There is no apparent reason for re granting a front yard setback reduction down to twenty feet and it won't be compatible with the single family neighboring properties in the West, which is the Oakwood Manor. [1:14:53, 1:15:05]: And the physical physical characteristics, which are the creek, floodplain, and step steep topography, are not the results of the applicant, but it doesn't justify a reduction of the front yard setback. [1:15:07, 1:15:17]: And the fourth, um this will be greater than any other deduction previously granted for other properties, and that will therefore be a sp special privilege. [1:15:22, 1:15:40]: And as far as the request number two, um the stopridge city council has approved SAD setback reduction in the past five years, but the applicant hasn't demonstrated the necessit n necessity for such reduction. And without granting the variants, the land could still be used for building a smaller townhome development with larger [1:15:42, 1:15:43]: But fewer autonomous units. [1:15:45, 1:15:55]: And no apparent re there will be no apparent reason for granting a side yard reduction from fifteen to ten feet. The reduction of only five feet is not as significant. [1:15:56, 1:16:16]: So as far as the staff recommendation, the first variance request number one, the denial of the app denial of the applicants to reduce the front yard setbacks of the townhome lots from the required fifty feet to only twenty feet in the MFR zoning district, and B the approval of the reduction in the front yard setbacks of the town. [1:16:16, 1:16:27]: Thomas Home Lots to thirty feet. And as far as the second variance request, that will be approved of this request to reduce the side yard setbacks from the required fifteen feet to ten feet to proposed townhome lots. [1:16:31, 1:16:33]: And that would clear the presentation for the first case. [1:16:37, 1:16:38]: Thank you. [1:16:40, 1:16:53]: Okay, with that I'd like to ask if there's any representation from uh Lanaire Georgia or their agent, Bell L S C. If you would please step forward. State your name and your address, please. [1:17:00, 1:17:08]: Good evening. My name is Josh Mahoney and I'm an attorney at Battle Law PC. Address three five six two Habisham at North Lake in Tucker, Georgia. [1:17:08, 1:17:09]: You all hear me okay? [1:17:10, 1:17:25]: Excellent. It's great to see you all this evening. I'm really happy to be here to discuss this proposal with you all. This property has kind of a storied history, I think. Originally this property was part of the DRI. [1:17:25, 1:17:37]: That went along with Walmart. And this piece of property in particular was meant to be the residential portion of that overall development, with Walmart being the commercial anchor. [1:17:38, 1:17:48]: And this parcel being the residential support uh that would go along to help the Walmart and what would as we know become the surrounding commercial uses. [1:17:49, 1:18:09]: Unfortunately, to this day, it does remain vacant. However, our application is seeking to capitalize on that vision and bring it to fruition. And so what we've done is we've submitted a future land use amendment, rezoning, and a couple of variances to try to to make that plan happen. [1:18:09, 1:18:22]: We're submitting a future land use amendment from medium density mixed use to medium density residential, a rezoning from C two to MFR, and variances to reduce some setbacks, as uh the planning staff have pointed out. [1:18:23, 1:18:43]: Um I'm sure you're all aware of the location of this property just west of Walmart and north of the Taco Bell behind QT on Hudson Bridge. Um this is a property that that I have driven past growing up in the area and never really paid attention to it because it looked like a bunch of trees. Um but it's interesting to see, it's interesting. [1:18:43, 1:19:00]: interesting to see the history of this and and how it was a part of Walmart's um DRI process. So zooming in first on the rezoning application, um this is this is an image of Stockbridge's uh zoning map. [1:19:01, 1:19:10]: And as you can see, the property is currently zoned C2. Um the property is zoned C2, but it's also adjacent to some single-family homes. And so [1:19:11, 1:19:26]: What's allowed today is much more intense than what we're proposing. Um anyone, a commercial developer, could come along and put up a a C2 use next to the existing single family homes. And we don't feel that that is an appropriate [1:19:26, 1:19:27]: Um [1:19:28, 1:19:40]: kind of use to butt up against single family detached. What we propose instead is a what's a pretty common practice across the nation, a transition from the intense commercial uses to the East. [1:19:40, 1:19:41]: Down to [1:19:41, 1:19:58]: uh town homes or something like that, like what we're proposing, into the less intense single family detached homes. And what you get here is a ramping down of uses, um, but you're still kind of addressing the need for housing um to fuel that commercial node. [1:20:00, 1:20:18]: Um luckily for us, there's already some MFR zoning districts in the area immediately to the north of the subject property and south of the subject property across Hudson Bridge Road. So we're not introducing a new zoning district to the area. We're just continuing the trend that is on this uh western portion of the city. [1:20:21, 1:20:38]: Looking now at the future land use map, we are proposing uh medium density residential. Again, we've got high density residential already in the area, so we're not bringing anything more intense than what's already there. Uh just need to switch that out so that the MFR district is compatible. [1:20:40, 1:20:43]: We talked about the site plan already with the planning staff. [1:20:43, 1:20:45]: Um some things I do want to point out. [1:20:47, 1:20:48]: You can really start to see [1:20:50, 1:21:10]: On the on the um this is actually the eastern side of the property, it's flipped on its side here. Uh there's a stream that runs along the length of the property, and with the stream comes a stream buffer, 75 feet on either side of the stream from the point of rested vegetation, 150 feet total. That eats up a lot of [1:21:10, 1:21:27]: a lot of this property um and taking into account that piece plus the topography of the site and the strange shape of the site, it really makes it a difficult property to develop, which is probably why it's remained vacant for so long. [1:21:27, 1:21:33]: Um considering it's zoned commercially as well, it's probably also c a contributing factor to its vacancy. [1:21:34, 1:21:46]: Um but this plan uses the available space and uses it uh to bring about that the vision that was put forth under the Walmart DRI. Uh we are at this time proposing a clubhouse. [1:21:47, 1:21:47]: Pool [1:21:48, 1:21:50]: And a playground. [1:21:54, 1:22:04]: Here we've got some renderings. This is this is a um aerial rendering of what the site will look like, as well as a rendering of what the pool area will look like behind the clubhouse. [1:22:07, 1:22:27]: Top left here is a rendering of the of the clubhouse from the front. And we've got some updated elevations and um updated since the last time we were able to to speak to the staff. Um so what you see on the bottom here are the two car garage units, and on the top right here are what the one car garage uh units are gonna look like. [1:22:30, 1:22:31]: And then last but not least [1:22:33, 1:22:41]: I have a fly through video for you all to to take a look at. This will be kind of what it's like to drive through the community. Uh we'll see if it plays for us. [1:22:45, 1:22:45]: Mm-hmm. [1:22:51, 1:22:59]: It may be that we have to go without the video this evening, but I'm happy to share that with you all should you like to see it. I have it on my computer and I can forward that to you after this meeting. [1:23:00, 1:23:04]: I'd like to take a moment since that's the end of my oh, here we go. We got it. [1:23:06, 1:23:17]: So this is kind of what it would look like if you have the just off screen here the um clubhouse. So this is what it would be like to come into the subdivision here. Excuse me, the neighborhood here. [1:23:31, 1:23:51]: So the developer is using kind of a mixture of facades to break up the unit so you can tell one from the other. I know in some townhome communities that is an issue where you have a kind of monotonous cookie cutter look. Uh it doesn't look good. Um so we're using a mixture of materials, colors, things like that to break up that. [1:23:51, 1:24:03]: That monotony that you might get, and also using a mixture of high-quality materials like brick and board and batten. Here's the clubhouse, coming at it from the side, like as if you were going to the pool. [1:24:10, 1:24:13]: And then of course here's the pool that the folks will be able to enjoy. [1:24:24, 1:24:44]: So I'm actually gonna pause the video there. I'd like to take my remaining time to try to address some of the conditions that staff mentioned in their report. Um for the most part, my client does accept um the conditions. However, there are a few that are pain points for us that we do need to discuss. [1:24:44, 1:24:45]: Um [1:24:46, 1:25:02]: One is that the planning staff are requiring that we have centralized trash receptacles. That won't be necessary. We're actually going to use curb pickup. So each unit will have a uh big green bin that they can put at the curb and that'll be picked up. So there's no need for a centralized facility. [1:25:05, 1:25:07]: Um the other pain point for us is [1:25:08, 1:25:28]: Uh per the conditions, we're being required to have eight-foot wide sidewalks throughout the internal on the internal streets of the development. This is above and beyond what the code requires. The code requires five-foot sidewalks, and we are happy to supply five-foot sidewalks throughout the entirety. Uh it wasn't really made clear why we are being asked. [1:25:28, 1:25:48]: Asked to do eight-foot wide sidewalks when we're already cramped for space and asking for variances to make more space. I'm not sure. I know that we're not able to accommodate an eight-foot-wide sidewalk, but what we can do is towards the front of the development where the clubhouse would connect into Hudson Bridge Drive, we could put an eight-foot [1:25:48, 1:25:59]: sidewalk there so folks would when they're traveling from the clubhouse up to Walmart would have a big, nice, wide sidewalk that they could enjoy that would include widening the existing sidewalk. [1:26:00, 1:26:01]: On Hudson Bridge Drive. [1:26:03, 1:26:15]: Uh lastly, there was a condition that was um asking that only twenty percent of the townhomes be one car garage uh and that they be full brick facades. [1:26:17, 1:26:35]: If we were to abide by that kit condition per the language, we would lose so many units that the the deal would would die essentially. So that's not something that we can do. What we can do though is we can do three sided brick on the one side on the one car garage units, uh, but we can't do the the percentage piece. [1:26:39, 1:26:51]: Um but with that I ask that you all would consider uh approving, recommending approval of these applications this evening. Uh I'm happy to take any questions and I'll reserve any time I have uh for rebuttal. Thank you. [1:26:56, 1:27:05]: Any questions from the board? May I speak chairman? Yes, go ahead, Harold. Uh you were speaking about the uh sidewalks from five feet to eight feet. [1:27:05, 1:27:25]: Have you ever considered the fact that they might want a golf cart to roll through there, or you may have a bunch of senior citizens and they may want to ride up to Walmart? Uh I would think that might be the reason why they want you to go from five to eight feet. That may be the consideration and I'm not sure about that, okay? [1:27:26, 1:27:31]: Yeah, I'm not sure I'm not sure why or what the reasoning is behind that. Um [1:27:33, 1:27:34]: I think [1:27:35, 1:27:55]: If folks are trying to drive a a golf cart through the development, they could do that in the roadway. I actually don't think Georgia State Law allows for vehicles on sidewalks. Um I ran into that when I was in college. Uh a police officer told me to get my bike off the the d the sidewalk actually. So um I don't think state law would allow for a a [1:27:55, 1:28:05]: golf cart. But um if if the city does allow that, they could certainly take advantage of the connection from the clubhouse up to Walmart uh once they can get to the front of the development. [1:28:08, 1:28:28]: Thank you, Chair. I have a uh a plethora of questions. One, I I just have to say um I have to agree with one of your statements. It definitely looks like a cram development. Um, like you're cramming it into the property, and that's one of my hugest concerns. Um one on top of a few questions. Could you just tell me because I don't think I heard the number when Gordon was [1:28:28, 1:28:34]: Speaking, he was going a little fast. What was the number out of the 140 that are for small town homes and large? [1:28:35, 1:28:39]: One hundred and one are twenty foot wide and the ballads are the twenty four foot. [1:28:41, 1:28:45]: Okay. Thank you. Um [1:28:47, 1:28:56]: So I I I know that area. I I'm I born and raised in Stockbridge. So I grew up in that area. And um one of the biggest things for me is when I looked at the site plan [1:28:57, 1:29:17]: You're taking you have two two accesses to the the property, which congratulations, we gotta have that anyway, but you have the one on Hudson Bridge Drive, which that hill or that turn is already concerning to multiple people on multiple levels. One. And then two, the second one you have, it goes right into the adjacent [1:29:17, 1:29:27]: community. So let's say it's a fire in your community, right? The fire department would have to hit Flippin' Road, which is already traffic junction 247. [1:29:28, 1:29:33]: to then hit that neighborhood to then come into your property. Is that correct? [1:29:34, 1:29:54]: No, that's not correct. Okay. The fire department would have access. They would have access from either either access. So they could access from Hudson Bridge Drive or Oakwood Manor. Um but the access through Oakwood Manor is only to be used in the event that access through Hudson Bridge Drive is not available. So will that be dated? Yes. Okay. Cool. [1:29:54, 1:29:56]: That was another one of my questions. [1:29:58, 1:30:15]: Mm. And I'm glad you said uh uh a that they are requiring this we love our staff, but they're requiring a full brick um setback around the entire town home because th being on that hill and with that creek, you're definitely gonna want that. Um but another thing I wanted to ask you was [1:30:16, 1:30:36]: Two two last questions for me at least. Um homeless in that forest, because I we know a lot of we don't see a lot of the homeless in Stockbridge, but we know for a fact they're in the the trees, they're in the forest. And even though it may look like a nice community, we do live in a great community. We do have a homeless issue we that we have to address at a city level. I'm not saying that's something [1:30:36, 1:30:56]: That you all have to address. But if you're going to build this development, what is it going to cost for those that are living around that area? Because all of that is going to be moving. Like, did you all do an impact study in regards to that? And like, so homelessness and crime, because that is consort of Cam City. Hudson Bridge is kind of tedious there. So did y'all address that at all? [1:30:56, 1:31:16]: So I'm I'm not aware of any homeless uh folks who are living on the property. And I'm I don't believe that the applicant is aware of that either. However, uh if they are there, then I mean they're not supposed to be there. That would be trespassing. Um so we did not take that into consideration when doing an impact study. I don't I don't think that's [1:31:16, 1:31:20]: [5480.2, 5498.3]: It's n it's not. I just wanted to see if you all took that full advantage'cause regardless of if you're coming into the city, you know it is a community and we are a community based city uh at whole. But what's the price meme as well? That's gonna be my last what's gonna be y'all price point for sure. Yeah, they well using today's projections they would range between three hundred and thirty and three hundred and sixty thousand. [1:31:40, 1:31:41]: Okay, that's all I have chair. Thank you. [1:31:43, 1:31:54]: May I speak, Mr. Chair? Yes, sir. Um very much aware that uh you guys have fenced that in. They did have issues with homeless people in that area at one time. [1:31:54, 1:31:59]: uh that was a haven for bad behavior at one time. Um [1:31:59, 1:32:00]: Uh [1:32:00, 1:32:12]: There was a lot of issues with that property when it comes to homeless. So I just want you to make make you clear of that that we've had some issues with that particular piece of property when it comes to homeless. [1:32:13, 1:32:17]: Thank you. And I I d I would to that I would say [1:32:21, 1:32:41]: If we if we're if someone is able to develop the property, um homeless folks would not be able to access it and just walk around uh without anybody noticing. So having a development there, having eyes on the street uh would cut down on any bad behavior coming from from uh anybody who's trying to get through that property or anything. [1:32:41, 1:32:42]: [5566.2, 5567.4]: Any other questions from the board? [1:32:49, 1:33:09]: Yes. I I'm I'm all in favor of having this property zoned for residential rather than commercial. My only question is though, have you given consideration to the intersection of Hudson Bridge Drive where it enters into your property in any kind of traffic control device? By the traffic study, the amount of vehicles [1:33:09, 1:33:23]: vehicle traffic in and out of your development is going to be quite high. And right now if you know that intersection is a cluster as it is when the light turns red going out on the Hudson Bridge. [1:33:23, 1:33:43]: And people want to turn into the Taco Bell or Quick Trip or the Bottle Shop, and then you have people coming in and out of that alley, that that small piece of road right there that curves up to the shopping center, it is a traffic jam. And you add more hundred cars to that, if there's not some kind of [1:33:43, 1:33:51]: traffic control device, I think, at that intersection where all three of those roads meet, it is going to be horrendous. [1:33:53, 1:34:05]: So okay, that that's that's very interesting. I am familiar with the intersection. I I grew up uh not far from here and I used to frequent and get my gas there at the quick trip. So I know what you're talking about. Um [1:34:06, 1:34:26]: So when folks are exiting and entering the subject property, they would actually have two ways to do it. Um, not through Oakwood, that's gonna be gated. They could go out Hudson Drive, uh, excuse me, Hudson Bridge Drive, onto Hudson Bridge Road, and try to take a left or a right. Um, there's actually uh I'm sure you're aware. [1:34:26, 1:34:46]: So if if traffic is backing up on Hudson Bridge Drive, folks can detour thinking people are gonna make a left turn out of your [1:34:46, 1:35:01]: Development onto that road to use the stoplight at Walmart to come out. It's an option. And I what I'm what I'm trying to say is yeah, there's good road connectivity here so that folks can go in and out at different locations to try to alleviate that one intersection. [1:35:01, 1:35:21]: Okay. Drive and and Hudson Bridge Road. So it's too close to have another stoplight within the vicinity of that stoplight out onto a main artery. And I just see traffic in that area being terrible. Oh I'm not suggesting that I'm not sure. [1:35:21, 1:35:41]: I'm suggesting using the infrastructure that's in place. Right. So if folks are trying to get out uh from this development and turn right on Hudson Bridge Road, what they could do is actually start by turning left on Hudson Bridge Drive, working their way over to where there's a right in, right out, take that right, and actually I don't know if you can see. [1:35:41, 1:35:45]: the screen, it would kind of come over here and then come back this way. [1:35:46, 1:36:06]: Well, unfortunately that's really the only other option, but I don't think it would be very beneficial because you're gonna back up that stoplight then coming out of Walmart with the additional hundred cars coming out of that neighborhood, you know, going to work wherever they go. So it it that really needs to be evaluated. Uh like I said, I'm in favor of developing [1:36:06, 1:36:25]: at residential, but that area really needs to be evaluated. And there are three parcels of property that merge right there. So before any improvements could be done, um the property acquisition would have to take place. Sure. Whereas whoever did the development wouldn't would own all the pieces that are involved right there. [1:36:25, 1:36:45]: Well what I can say is we we do have a traffic study. Um and the study told us in the morning time um trip generation would be about I I think it was um forty or fifty trips in the morning. Is that better? So during the AM peak hour, I think the traffic study was set. [1:36:45, 1:37:05]: Saying something like 40 or 50 trips and it was a bit higher in the evening, closer to 60 or 70 trips. Um but the the impact study did say that traffic even with the development would be comparable to the no-build situation. Um just that's a slight increase in traffic, of course, with with new new development, uh, but nothing that would. [1:37:05, 1:37:19]: completely derail uh the traffic situation as it is or as it's projected to be with one exception uh and it did have some some recommendations to alleviate that and that's something that we're willing to commit to. [1:37:20, 1:37:40]: Yeah, I think at a minimum they would have to adjust the timing on the stoplight green light coming out of Hudson Bridge Drive to allow for more traffic to exit that area because right now it's ten cars. That's all that can get out of there in between the stoplights. So that's something the DOT would have to look at. And we're we're certainly. [1:37:40, 1:37:43]: Okay. [1:37:44, 1:37:44]: Thank you. [1:37:45, 1:38:05]: Any other questions from the board? One more thing, Tier. I'm sorry. Go ahead, Mr. Williams. Thank you. Um I I definitely have to have to uh second what my commissioner on the other side uh said to you. That's definitely one of the more concerning parts. And I if we're gonna uh you're not selling it for me, if we wanna sell it, you saying the multiple parts of I know we think [1:38:05, 1:38:25]: They can they're gonna turn left, but typically when we're leaving the house and we're trying to get to where we need to go, we're gonna find the fastest route and that's gonna be that right, right there to stop sign or the red light to turn left or right to go where we need to go. Um but I did have one more question. Your traffic impact study, I know it was submitted to the office on June in June. Was it conducted in [1:38:25, 1:38:26]: In June as well. [1:38:27, 1:38:47]: Oh, it's been a while. I'd have to double check that. Okay. Um if you're asking about school traffic, this traffic engineer in particular always factors in school traffic. Uh he has collected school traffic data for the past several years. So even if school's not in, he factors it in and increases it by about five percent just in case. Okay. I just wanted to make sure because we are, you know, we we have news. [1:38:47, 1:39:07]: Because they have recently just opened and less than a week ago. Yeah. So we want to make sure when we're talking about tra uh traffic studies in regards to the school hours as well that we're adding those new additional schools that have added bus routes and car routes like that as well. Um but that's all I have, Chair. All right, five questions from the school. Mr. Chairman, can I ask just one question? [1:39:07, 1:39:11]: Is there just one entrance and exit from that property? [1:39:12, 1:39:18]: No. So here I'll pull up the site plan one more time. We're showing two [1:39:19, 1:39:19]: Points. [1:39:21, 1:39:32]: of ingress and egress. So this down here, this is Hudson Bridge Drive, and this would be the main access. We're showing access on Oakwood Manor. [1:39:32, 1:39:34]: However, this is going to be gated. [1:39:35, 1:39:41]: and only accessible by emergency vehicles in the event that access is not available off of Hudson Bridge Drive. [1:39:42, 1:39:48]: And so the the purpose there is uh really when we were talking to the fire marshal, he told us we had to have two entrances. [1:39:49, 1:40:02]: Um for safety purposes. However, we didn't want to have to we didn't want to impact the folks at Oakwood Manor by having our traffic divert through their neighborhood. D we didn't think that was fair. A compromise that we came up with with the fire marshal is gate that. [1:40:03, 1:40:18]: Uh staff has recommended that we gate that. We're happy to do that. Uh we think it makes the most sense uh for making sure folks from this development don't go into the neighboring development um and still ha still still meeting the fire marshal where where he needs us to be. [1:40:20, 1:40:20]: Thank you. [1:40:22, 1:40:42]: Mr. Chairman, if I could add one more thing, one more statement. Yes, Mr. Cobb. Anticipating some residents moving in there that have children and there would be children going to school. Um, by the look at the map, there's no way a school bus is going to be able to navigate inside that neighborhood, which means a lot of kids are gonna have to walk down to Hudson. [1:40:42, 1:40:45]: Bridge Drive for a school bus to pick them up down there. [1:40:46, 1:41:06]: So the roadways here are going to be designed to city standards which have to accommodate accommodate a fire truck. They'll also be able to accommodate a school bus. Uh in the event that a school bus kind of tries to consolidate the pickup point, that was that's what they did for me when I was a kid. Um I would recommend the clubhouse for having having [1:41:06, 1:41:15]: having students consolidate there. Um so that way the bus could get in, kind of use the the turnaround there to quickly pick children up and turn right back around and get out. [1:41:16, 1:41:31]: I know this property is uphill from Hudson Bridge Drive, where you it meets Taco Bell and the filling station. Yeah. Um what kind of a grade do you think they're going to have to climb to get into the property from from there up to [1:41:31, 1:41:32]: Yeah. [1:41:32, 1:41:33]: So [1:41:34, 1:41:51]: To be the short answer is I don't exactly know what the grade is. Um I I was speaking with my engineer today and when he was talking about grading, he mentioned only having to grade um a small amount of land over here in the southeast corner of the plan. Um [1:41:52, 1:41:53]: The rest of it's kind of okay. [1:41:53, 1:42:00]: Okay. Yeah. But I can get that number from you or for you. I just have to reach out to my engineer to get the exact grade for you. [1:42:07, 1:42:09]: Alright, any final questions from the board? [1:42:11, 1:42:20]: Okay, if not, we're gonna open it up to the community. Again, if you are in favor of the application, we ask that you form to your left. [1:42:21, 1:42:24]: Please make sure that you sign the um board. [1:42:26, 1:42:30]: Okay, if you are opposed, we ask that you line up to the right. [1:42:32, 1:42:33]: Okay. Yeah. [1:42:34, 1:42:54]: Please make sure she's speaking to the microphone. State your name and your address, please. We'll do. I'm Tim Callahan. I live at 146 Oakwood Circle, uh immediately adjacent to the subject property. Um this property does have a storied history, and and at you know, using some of the words that uh were mentioned at the uh community information meeting that was [1:42:54, 1:43:00]: is inappropriately dated on the battle law notice as the eighth. Um [1:43:01, 1:43:02]: They are squeezing. [1:43:02, 1:43:05]: Every bit out of this. And I want to unpack that a little bit. [1:43:06, 1:43:09]: Well let's start with the fact that there is a thirty to forty foot drop. [1:43:09, 1:43:13]: From the upper side of the property behind our homes down to the creek. [1:43:14, 1:43:23]: They showed a very level fly-through with easily forty foot driveways. That's a video that's make-believe. [1:43:24, 1:43:31]: There's no way that they're going to be able to build these townhomes without half the foundations on fill and the other half on cut and retaining walls everywhere. [1:43:33, 1:43:46]: On top of that, they're talking the well I appreciate the uh planning uh employees putting planning staff putting together some good recommendations of having a buffer with tall trees. [1:43:47, 1:43:49]: This type of development will mean clear cut. [1:43:50, 1:43:51]: And then eventually plat something. [1:43:52, 1:44:05]: What kind of plant, we don't know, how long before the growth to maturity, we have no idea. So I'd like to ask for you to consider adding the idea of a no-disturb buffer as opposed to uh simply saying plant trees and put up a fence. [1:44:06, 1:44:15]: Additionally, in a traffic study, as I s noticed it, I may be wrong, it was referring to two exits and two different trip numbers for those exits. [1:44:15, 1:44:16]: One of those will be [1:44:16, 1:44:18]: Gated according to the new [1:44:18, 1:44:19]: information. [1:44:19, 1:44:23]: Which means it doubles what's coming out the other side. So instead of sixty [1:44:23, 1:44:24]: Or eighty. [1:44:24, 1:44:26]: We're looking at over a hundred trips. [1:44:27, 1:44:32]: Each of you have been to the QT, you've seen how well people respect the roadway markings on that road. [1:44:33, 1:44:34]: For where people should drive. [1:44:35, 1:44:35]: Obviously none. [1:44:36, 1:44:37]: This will compound that. [1:44:38, 1:44:52]: You've seen the turns there. I appreciate the fact that you brought it up that the turn there to go with in the Walmart area is an acute left turn, generally uh problematic, just without the extra traffic. You add this in, it's gonna compound that substantially. [1:44:55, 1:44:55]: So [1:44:58, 1:44:59]: This [1:45:00, 1:45:04]: Development does have a history. It was a Baptist church property at one point, way back when. [1:45:04, 1:45:24]: It went through a variety of different uh plans and the idea of saying, okay, we'll have this mixed use with commercial and residential. And then previous administration and management of the city allowed for an absolute massive overdevelopment of the commercial area, leaving this left as zoned commercial rather than going toward the comprehensive plan for it to eventually be rezoned. [1:45:24, 1:45:25]: It has mixed use. [1:45:27, 1:45:30]: No residential was built because it wasn't as profitable. [1:45:31, 1:45:31]: As commercial. [1:45:32, 1:45:35]: To that end, for y'all as a recommending to the city. [1:45:36, 1:45:38]: Residential property is never gonna provide [1:45:38, 1:45:40]: You a return on investment. [1:45:41, 1:45:53]: for the city, because the services that are gonna be in demand here will never be paid for by that much residential use. The fire, the police, general building inspection, all that. [1:45:53, 1:46:03]: I do hope that you consider I I like you, I'm for this being residential. I think it would be a good fit. But this density is ridiculous. [1:46:04, 1:46:08]: This density is to the point to where it's going to I [1:46:08, 1:46:16]: cause extraordinary erosion to the area, the impervious area of the roofs, the sidewalks, the ground is going to flood that [1:46:16, 1:46:17]: stream [1:46:17, 1:46:22]: Which is sensitive and polluted as it is because of simple trash coming off Walmart area. [1:46:23, 1:46:32]: With soil and debris, l yard clippings and everything else. It's gonna damage the watershed there. It's gonna end up resulting in some flooding downstream. [1:46:32, 1:46:37]: Because this yard debris and everything else will end up clogging up the culverts and so forth downstream. [1:46:38, 1:46:56]: I also recommend that you also consider while you don't make recommendations to the cities or or to the school saying, Hey, you should do this or that, I reckon I respect the fact that your job here is to ensure plan for the welfare and will and quality of life for the folks who are city of Stockbridge. [1:46:57, 1:47:09]: Part of that is a good quality schools where the kids are not overcrowded. You may have awesome teachers, you may have awesome parents. But if you have thirty kids in a school and half of them are having to sit in a trailer because of overloading, [1:47:10, 1:47:20]: It's hard for a parent to make up for that. I apologize, but we are over two minutes before we can vote to ascend the speaker's talking time. [1:47:21, 1:47:41]: Approved. One minute, please. I appreciate it. As this is three items together, four items together, I like to address them as such. The fact is is that this item is very sim this zoning was originally similar to the first item on the agenda. It was going to be a variety of different things. Great plans, great idea, but now because of the past d decisions. [1:47:41, 1:47:48]: We're having to suffer for squeezed in development trying to force it here. And the last thing I want to point out in the last two years. [1:47:49, 1:47:54]: The twenty-five percent of the homes that have sold in the last two years in the same price point. [1:47:55, 1:47:57]: Have been sold to non owner occupants. [1:47:57, 1:47:59]: Meaning they've gone to rental. [1:48:00, 1:48:06]: This property being supposedly at this price point, when adjacent properties do not meet this price point as single price. [1:48:07, 1:48:09]: А сингл девеломент хомс сингл стан хомс. [1:48:10, 1:48:12]: There's no way you can meet the price point they're re they're referring to. [1:48:14, 1:48:15]: If this place goes and [1:48:16, 1:48:16]: Gets built. [1:48:17, 1:48:25]: It's gonna be bought up by an investor like the place across the street, the that they tout as, hey, this is also a nice uh dense use. [1:48:26, 1:48:28]: Within two years of that townhome development, [1:48:28, 1:48:31]: The vast majority of those were bought up by a single owner. [1:48:34, 1:48:35]: Thank you. [1:48:40, 1:48:40]: Yes, ma'am. [1:48:46, 1:49:06]: I want to thank the uh council and the beautiful presentation from the company. My name is Jocelyn Williams. I live at 190 Banks Drive. The brand new school that was built is Birch Creek. That's where I work. We went from a projected 525. We're now at 725 students, and it is still growing. Uh my concern is [1:49:06, 1:49:18]: is the one way in and the one way out uh and the safety for the children. I'm concerned about the infrastructure and the six point eight seven per acre and the surrounding use that the um [1:49:19, 1:49:39]: uh that has been permitted by the planning and zoning, they're gonna approve it. But I just wanted to put my opposition like the other uh resident, the people that live there is going to be a nightmare. I get up at four o'clock in the morning so that I can beat the traffic and I come home at six and seven at night as a teacher. So as you're making your considerations for approval. [1:49:39, 1:49:49]: I know that we have to have places for people to live, but please listen to the residents. And I want to thank you again, once again, beautiful residential area that you're building. Thank you so much. [1:49:50, 1:49:50]: Thank you. [1:49:52, 1:49:54]: Any other comments from the community? [1:49:57, 1:50:17]: All right, with that, I would ask for a motion from the board, please. Chair. Um I'd like to thank both of the s the community speakers for speaking and kinda hitting uh some some of the points that uh we as commissioners have also hit for those that's spoken, but I would go ahead and like make rake make a recommendation for [1:50:17, 1:50:23]: us to deny um item number CP dash twenty twenty four dash oh one. [1:50:26, 1:50:34]: And Mr. Jaden, that would also include RZ twenty twenty four dash zero one. Yes, sir. Okay. Do I have a second to deny? [1:50:34, 1:50:35]: A second. [1:50:35, 1:50:40]: Mr. Thomas seconds. All in favor to deny? Aye. [1:50:43, 1:50:45]: [6645.9, 6648.3]: Three ayes to deny. [1:50:51, 1:51:00]: Okay guys, I couldn't hear you. So Thomas said aye, uh Planton and Tibetal said nay. So we have two ayes, we have two opposed, correct? [1:51:02, 1:51:08]: So I will cast the tie breaking vote. I vote opposed. The application is denied. [1:51:12, 1:51:13]: With that [1:51:14, 1:51:16]: Regarding the variances [1:51:18, 1:51:22]: VR twenty twenty four dash zero three, twenty well item six. [1:51:24, 1:51:30]: The motions and the Yes ma'am. So we had two nos. Two posed. [1:51:33, 1:51:38]: We had two approvals. I cast the tie breaking vote as a no to deny. [1:51:42, 1:51:45]: The application. Could you not hear who said it? [1:51:55, 1:52:03]: All right, as the application has been denied, I'd like a motion from the board um to defer the variances. Can I have a motion, please? [1:52:04, 1:52:05]: Yes, ma'am. [1:52:11, 1:52:13]: Understood. Thank you. Appreciate that. [1:52:16, 1:52:20]: Okay, with that we're gonna move on to item seven. [1:52:21, 1:52:41]: As regards, and I'm gonna read all three folks, just so you know. CP 202406, this is a comprehensive plan amendment case, CP 202406 to be located in Council District 5. [1:56:43, 1:56:53]: So these are the these are the presentations for CP twenty four dash zero six, RZ twenty four dash zero six, and VR twenty four dash zero two. [1:56:55, 1:57:00]: As mentioned, the applicant is LI Route twenty-three LLC. [1:57:00, 1:57:20]: And the owner is LI Route 2020 Route 23 LLC with the agent being George Harper of Paramount Engineering. The number of proposed units per acre is 7.33, and the address of the property is 26 Highway 42 North. And zero and the parcel ID number is 0633. [1:57:20, 1:57:26]: six nine dash zero one zero zero nine thousand. The number of acres is thirteen point six four acres. [1:57:27, 1:57:36]: The characteristics of the property is that the site is currently vacant and wooded with a systems d deceleration lane and entrance on the right. [1:57:36, 1:57:47]: The current future less use land use designation is low density mixed use and the current zoning of the property is C two and the sign was posted on july sixteenth of twenty twenty four. [1:57:49, 1:57:55]: So this is the vicinity map. As you can see it's adjacent from CNC fence. [1:57:55, 1:58:15]: Who's the owner of these the the larger parcel? You have CBS, you have Elite Collision, you also have the Eagles Peak Shopping Center, which is here, and you have the Lakeside at Eagles Landing, you have Brandon's Walk, and you also have the St. Luke's Lutheran Church, and you also have the Canon Cleveland Funeral Directors, and you also [1:58:15, 1:58:20]: To have the parkside at Eagles Landing subdivision, the parkside office plaza, the [1:58:21, 1:58:23]: Parkside Plaza and the Marathon Gas Station. [1:58:26, 1:58:29]: And this is the aerial photo with the side plan as shown. [1:58:34, 1:58:37]: And this is when the sign was posted on July sixteenth, twenty twenty four. [1:58:40, 1:58:47]: And this is the existing deceleration lane that the applicant is gonna use as sho as will be shown as a side plan. [1:58:50, 1:58:59]: And further down you have Parkside Plaza. And to the right you have Elite Collision and CNC Fence, which is further down as well. [1:59:01, 1:59:05]: And to the left you have the park side of the Eagles Land subdivision. [1:59:07, 1:59:27]: As far as the zoning history of the property, the larger partial, which is shown with the green star, it was rezoned from RA, which was residential cultural, to C2 general commercial on May 6, 1997, as partial a larger property. And is in addition, the existing deceleration lane that is shown where the mouse is at the summer. [1:59:27, 1:59:30]: Subject property was completed around two thousand two. [1:59:34, 1:59:36]: The proposed development information. [1:59:38, 1:59:47]: LI Route 2023 is proposing to build a townhouse development with 100 units. The development will include a pool. [1:59:47, 1:59:55]: Playground, community mailbox, and two point eight one acres of open space. The development will utilize the [1:59:57, 2:00:16]: deceleration lane on Highway 42 North and will also install an emergency access on Highway 42 North. It will have main access from the Park View Plate subdivision and a twenty five foot buffer will be adjacent to the lakeside at Eagles Land subdivision. In addition, the community will also be gated. [2:00:19, 2:00:39]: So this is the side plan showing the uh hundred units. And over here, this is where the twenty-five foot buffer will be, to the right where my cursor is. And you also have the pool pool and the playground. And you also have the open space. And you also have the existing deceleration lane to the left. [2:00:39, 2:00:41]: And you also have the existing [2:00:43, 2:00:46]: Yeah, but existing road here that they will use as a emergency road access. [2:00:50, 2:00:53]: And so this is the close up view of the site data. [2:00:55, 2:00:57]: Estimated they will build over one hundred units. [2:01:02, 2:01:06]: And this is a rendering of the um proposed townhomes. [2:01:17, 2:01:21]: And this g now we go to the C P twenty four dash zero six. [2:01:23, 2:01:43]: The applicant's request is to change the current future land use designation from low density, medium use low density mixed use to medium density residential to allow for the proposed townhome development. Currently, the two parcels have a current future land use designation of low density mixed use, which is not compatible with the requested MFR zoning district. [2:01:43, 2:01:58]: Therefore, the applicant has requested to change the feature land use designation from low density mixed use to medium density residential. Page forty nine of the twenty four Comprehensive Plan provides a list of compatible zoning districts which includes the requested MFR zoning district. [2:02:00, 2:02:03]: And this is this comprehensive plan twenty twenty four. [2:02:05, 2:02:13]: And this is the definition of medium density residential, which is has a u density range from four units to seven point nine nine units per acre. [2:02:18, 2:02:23]: And this is the feature land use map. The area is surrounded by low density. [2:02:25, 2:02:31]: Low yeah, low density mix use, let low density residential, uh high density residential, which is shown. [2:02:32, 2:02:35]: And high density residential is shown in the orange. [2:02:40, 2:02:45]: And this is the the table showing the surrounding land use destination. [2:02:45, 2:02:52]: Once again, the majority of is low density mix use and you have high density residential and you also have high density residential as well. [2:02:58, 2:03:11]: And this is the surrounding land use densities with the estimate. So based on the um research that we did, the density range is consistent with the other densities of the subdivisions, surrounded subdivisions in the area. [2:03:13, 2:03:26]: And this is surrounding land use density maps as shown, with the properties shown in the yellow star. You have Brannan's Walk, and you have the lake side at Eagles Landers subdivision and you have the park side at Eagles Landers subdivision. [2:03:26, 2:03:28]: So the it's it's consistent. [2:03:31, 2:03:42]: Key points from that we did in the staff analysis is that it is consistent with the goals and policies of the comp plan as shown and these are the goals that they're consistent with, that align with. [2:03:45, 2:03:50]: The proposed MFR is compatible with the requested MFR zoning district. [2:03:51, 2:03:59]: And is suitable to the area since the other areas have a future land use destination of high density residential and low density residential. [2:04:03, 2:04:07]: And the proposed MFR is not compatible with the current [2:04:08, 2:04:16]: Current land use mixed designation. So therefore, that's why the applicant submitted a compliant amendment to change it from low density mixed use to medium density residential. [2:04:17, 2:04:20]: And it'll provide as far as the par oh, wrong one. [2:04:21, 2:04:22]: Okay. [2:04:24, 2:04:26]: So overall staff recommendation is approval. [2:04:30, 2:04:33]: And I will go into the rezoning R C twenty four dash zero six. [2:04:37, 2:04:57]: The applicant's request is to rezone from C2 to MFR to allow for the construction of the townhome development. Currently, the two parcels are zone commercial, general commercial. However, the C2 zoning district provides a list of permitted uses which does not include townhomes. Therefore, the applicant has requested to rezone the two parcels from C2 to MFR. [2:04:57, 2:05:05]: MFR Section two point four of the Stockbridge Unified Development Code provides a list of permitted uses, which includes townhomes. [2:05:05, 2:05:06]: Mm. [2:05:10, 2:05:23]: And this is a zoning map and the properties shown with with the two stars. As you can see you have L I, you have O I and you also have M F R on the left and right, and you also have C two as well. [2:05:24, 2:05:28]: And you also have S SR, which is single fam suburban residential. [2:05:32, 2:05:37]: In addition, the property is part of the overlay Pocre Mixus Overlay District. [2:05:42, 2:05:47]: And the key points to analyze from that we analyze is that the pro proposed MFR [2:05:48, 2:06:08]: The proposed MFR is compatible with the current um land use mix designation. It's consistent with the UDC, and as far as the positive effects, it will provide alternative housing types for first-time home buyers and it will generate an increase in revenue for businesses of the nearby shopping center. Also, water and sewage is available. [2:06:08, 2:06:15]: And any land use under the C two can be developed on these subject properties if it remains the same. [2:06:22, 2:06:42]: And staff recommends approval with the following conditions. Flock cameras will be located at the entrance of the proposed townhome development. A 25-foot buffer shall be established along the northern and southern portion of the subject property. A mandatory HOA shall be established. The units shall not increase 100 units. [2:06:42, 2:07:00]: Maranchal shall not exceed ten percent of the proposed townhome developments, and male chaos shall be established, and the reverence shown with the submitted application on july first, twenty twenty four shall be followed, with the brick being shown in the front and the sides is shown hardy plank sided. [2:07:03, 2:07:07]: And this is the v presentation for VR twenty four dash zero two. [2:07:10, 2:07:25]: With the applicant's request, the first variance is to r reduce the front yard setbacks of the townhome lots from the acquired fifty to thirty feet, and the second variance which is to reduce the side yard setback of the townhome lots between buildings from the acquired fifteen to ten feet. [2:07:26, 2:07:33]: This is the MFR district standards that are found in section two point four four of the Stockbridge Unified Development Code. [2:07:37, 2:07:48]: And the staff analysis that we did. Since staff is reviewing the MFR building standard standards, staff is in support of the requested variants. [2:07:49, 2:08:03]: And in addition, the requested variances, they're they're consistent with the overall purpose of the UDC. And in addition, the applicant may be prive of the opportunity to build a townhome community without the reduction of the front and side yard setback. [2:08:05, 2:08:09]: So based on our analysis, staff recommends approval for both variances. [2:08:13, 2:08:15]: All right. Thank you, Gordon. Appreciate it. No problem. [2:08:17, 2:08:20]: The uh applicant or representation, if you could please come. [2:08:21, 2:08:23]: Good evening. Please state your name, your address. [2:08:23, 2:08:29]: It's over just a second in my presentation here. [2:08:37, 2:08:38]: Here we go. [2:08:39, 2:08:59]: Okay. Good evening, Mr. Chairman. Uh board members, Vice Chairman, excuse me. My name is George Harper, Paramount Engineering, 11 East Broad Street, Noonan, Georgia. I'm here tonight representing the applicants. Um LI Route 23 uh for the rezoning um of this property. [2:08:59, 2:09:19]: So this property is currently uh owned by uh LI23, is the CNC Fence Company. They've owned this property for a number of years, uh back since the nineties, I believe it is. And they did come uh before the um city council uh a number of years ago to try to expand their fence company. [2:09:19, 2:09:39]: onto this property. Well their property is zoned LI and this property would have had to have been zoned LI as well. So it was denied uh at that time and so the property's just kind of been sitting there vacant. They've kind of had it for sale. It's been zoned C2, but just really haven't had many takers over the years. So I think they're getting a little older and they really want [2:09:39, 2:09:47]: and try to to move this property. And so we approached them or developers approached them about um [2:09:48, 2:10:04]: rezoning this for a town home development, especially with all the um development around it being residential, other than their property to the north, um, it seems like it would be a good fit. And so again, you know, we're just to kind of reiterate some of the things that um [2:10:05, 2:10:25]: that uh Mr. Linton said, you know, the property um is currently uh surrounded by residential. You've got some high di high density residential to the west, you've got some uh lower uh density residential to the south, but again some higher residential to the east. So uh in commercial and uh industrial zone to the north. [2:10:25, 2:10:45]: So this uh townhome MFR zoning is a is a good transitional type zoning, as the previous applicant said as well, from more single family higher density to some of the uh lower single family density as well. And then also uh you got commercial and industrial involved in there as well. So it's a it's a [2:10:45, 2:10:50]: good type of transitional zoning and I think the staff reiterated that point as well. [2:10:50, 2:11:10]: But again, we're trying to uh first of all amend the comp plan um from low density mixed use to the medium density residential, uh rezone from from C2 existing uh to MFR. Um we're applying for uh variances to reduce the front setbacks from 50 feet. [2:11:10, 2:11:21]: to 30 feet. Now the reason for this, if you look at most other um zoning code around this area, Henry County, Clayton County, [2:11:22, 2:11:25]: in their in their townhome type uh zonings [2:11:25, 2:11:30]: The front setbacks are normally twenty to thirty feet. The reason is for that is is [2:11:30, 2:11:50]: Um when you have smaller units, they typically the point of somebody buying those units is to have less maintenance, okay? Uh either older people or or younger folks. So when you bring the um houses a little closer to the road, you don't have as big a front yards to maintain. Um and it it it kind of makes the it more [2:11:50, 2:12:06]: more of a community type feel. And so that's typically the reason why uh these um setbacks are more in the 20 to 30 foot range. Uh 50 is is a little um excesses excessive from what you know I've seen in in most other municipalities. [2:12:06, 2:12:26]: And then as as far as the side setbacks, uh it's it's kind of the code says that uh in this MFR zoning that the minimum side setback is fifteen feet, but the minimum distance between buildings is twenty. So it would be thirty feet, but the code says the minimum distance between buildings is twenty. [2:12:26, 2:12:46]: So we're just trying to reduce the setback to make that match uh that part of the ordinance. And speaking with staff, uh, we kind of explained it to them as well in this process. And uh Mr. Linton had said that they are kind of in the going in the process of looking at that part in their code and possibly um maybe making some changes to that. So they do match. [2:12:46, 2:12:50]: uh you know w uh what everything matches. [2:12:51, 2:13:11]: Mm-hmm. Uh let's see the the tract is of thirteen point six four acres. Uh we've got plenty of open space. Um if you if you look at our site plan, we've got quite a bit more green space than maybe the the previous applicant had. We tried not to cram just every square inch of this property with units. [2:13:11, 2:13:31]: Uh I probably could have gotten another ten or fifteen units on this thing uh if we had had uh really tried to just cram it in here. But we wanted to to leave the the open space and make it more of a uh a an upscale feel. You know, this property is real close to Eagles Landing, this area is very near [2:13:31, 2:13:49]: nice. The surrounding area is very nice. So we wanted this to be more of an upscale type townhome development. And so we didn't try to cram every square inch of units in this property. You know again we have we've only got 100 units. We got sidewalks on both sides of the street. [2:13:49, 2:14:09]: Uh we're gonna provide a pool, a playground, a uh pool cabana um as uh uh guest parking. Uh that's that's a big thing now with a lot of these townhome developments that they're asking for is additional guest parking. Some of the concerns I I've in the last few of these that I've rezoned have been people um you know [2:14:09, 2:14:29]: Commissions worried about people parking on the street. Well, we provided ample space at the uh at the pool house as well as some additional parking at the rear of the property. When I say rear, I mean south uh west corner there. Now you can't really see it very well on this property uh or this this map, but on the southwest corner. [2:14:29, 2:14:34]: corner we have an emergency access drive. So this one will have two [2:14:34, 2:14:54]: Not really two, it'll have one access, but it has an emergency access on the southwest corner. Uh there's actually curb cuts uh for both of our entrances right now. There's a curb cut uh that uh lines up with Parkview Place, which will be our main entrance, and then there's actually a an existing curb cut as well uh for where we're [2:14:54, 2:14:57]: we're gonna locate the uh emergency access. [2:14:57, 2:15:11]: D cell lanes are already in, left turn lanes are already in. So we really don't have to do very much road improvements or uh any any kind of you know, amenities or I mean improvements on the uh G dot right away. [2:15:11, 2:15:15]: Which is good for for us and for you know, G Dot. [2:15:16, 2:15:36]: Uh we're gonna provide all two car garages. I know uh some of the products you've heard of have uh are wanna do some one car garages. We're not gonna do that. We're doing all two car garages. Uh they'll be all twenty-four foot wide. Most of the units will be eighteen hundred square foot plus. Um we're gonna do uh [2:15:36, 2:15:56]: It'll have brick stone accents on the front. I've got some render down here. Real nice looking products with a lot of stone and brick on the front. We're going to do kind of the metal type roof on the area above the garage. It's got a little overhang right there to kind of protect. [2:15:56, 2:16:02]: on the garage, so those will be kind of metal roofs on that area. Obviously uh shingle roofs on the on the main roof. [2:16:03, 2:16:05]: Uh let's see. [2:16:07, 2:16:17]: So that's that's kind of the the gist of what we're what we're proposing. Um I know the staff had made several uh recommendations and [2:16:18, 2:16:20]: You go through those, excuse me. [2:16:25, 2:16:35]: We are in agreement with all of those though. I can't read them off right now as he Mr. Linton went through them, but we are in agreement with all of those uh those recommendations. [2:16:35, 2:16:40]: And I just wanna point out one thing uh on this property. So it's currently zone C two. [2:16:40, 2:16:44]: And C two has quite a few [2:16:45, 2:16:47]: allowable uses by right. [2:16:47, 2:16:50]: And I just want to read a couple of these. [2:16:50, 2:16:51]: Just [2:16:51, 2:16:58]: So everybody's kind of aware of what could what could currently go on this property. A car wash, an auto repair shop, a pawn shop. [2:16:58, 2:17:02]: Drive through restaurants, tattoo parlor parlors, and vape shops. [2:17:02, 2:17:21]: So those are just some of the things that are allowed by right on that property right now. I I know if I lived in the area, I would much rather have um some residential than more commercial uh butting up against me. Um we're trying to design the property to where, you know, it it it fits in with the surrounding [2:17:22, 2:17:23]: uh communities. [2:17:23, 2:17:26]: You know, the property to our south is zoned M FR just like we are. [2:17:26, 2:17:39]: So um, you know, it's very compatible and a good transitional zoning and I think it'll be a very nice upscale uh product for this area. I'd like to reserve any time I have left for rebuttal, but I'll be glad to answer any questions that you may have. [2:17:39, 2:17:42]: Thank you. I'd like to open it to the board if you have any questions, please. [2:17:44, 2:17:44]: Mr. David. [2:17:45, 2:17:57]: This is Dave Planchan. I've got a question. Um you said about eighteen hundred square feet for each unit. How many bedrooms are you anticipating or what kind of mix of bedrooms do you think you'll have? It'll be a minimum of three bedroom. [2:17:58, 2:18:18]: Minimum of three? Minimum of three. Okay. Yeah. So there's going to be obviously families going to be interested in moving in here. Um again we think about schools. Yes. The accessibility of school buses, where the children are going to meet to get on the school buses, et cetera. Uh-huh. Have you given any thought to that or what were your ideas on that? [2:18:18, 2:18:38]: Yes, yes we have. I've got two small kids and and it seems these days and I think the the gentleman uh was saying this before, they kinda got to where they do more of a consolidated pickup nowadays. They don't go around to each house like they used to when we were growing up. So uh yes, again, our amenity area in the rear would be a [2:18:38, 2:18:39]: Great spot for that. [2:18:40, 2:19:00]: All the the way that it's kind of laid out, uh, you don't really have a very far walk from any of the units to that. I mean, you know, you can easily cut through to get back over to the to the amenity area and the bus pickup. So uh we got parking there for parents if they wanted to drive back there to you know let their child wait to pick up. [2:19:00, 2:19:16]: up so and a nice big cul-de-sac as well. So yeah, I I think you know we there's plenty of room and it's there's not a lot of, you know, big winding curves and sharp turns in this subdivision to, you know, to really inhibit any traffic movement. So if that helps. [2:19:19, 2:19:19]: Question. [2:19:19, 2:19:33]: Um two two actually questions. He took one of'em. Um what's the price point starting? The price point of these are gonna be pretty similar to the last one. They're gonna be in the three hundreds, I mean three thirties up. [2:19:35, 2:19:38]: Depending on what you had, you know, as far as amenities when you build'em out. So [2:19:39, 2:19:41]: Okay. And I um [2:19:42, 2:19:59]: I actually wanted to see if you would go into one of the staff recommendations for variance one, which is reducing the front yard setback um from fifty feet to thirty feet. Um, I actually want to modify the staff's uh variance to thirty five and see if you all be willing to do thirty five. [2:20:00, 2:20:02]: Can I ask the reasoning behind that? [2:20:03, 2:20:20]: For me, I I've seen some of these developments and I'm I'm fairly new with you guys as um actual developer, but I would feel more comfortable with thirty-five than thirty, seeing that some of our developments and townhomes in our city um we've had some issues with thirty. Okay. And so I would be a little bit more comfortable with that extra five feet. [2:20:29, 2:20:37]: Yes, I mean we'll t we we take that under advisement. I mean I will I'll be honest with you the thirty feet came from staff. Uh [2:20:40, 2:20:44]: He does early still that's what it is. [2:20:44, 2:20:50]: Yeah, from the back of curb. So you're really almost forty feet from the back of curb. So you're only forty one feet. [2:20:50, 2:20:51]: from the curve. [2:20:51, 2:21:00]: Where the curve is at the start of the house for 41 feet, because there's 11-foot ride over there where all the utility verand is not included in the setup. [2:21:00, 2:21:01]: Gotcha. [2:21:04, 2:21:10]: Correct. Gotcha, thank you. Yeah, that's he's a developer, yes. Okay, thank you. Sorry. [2:21:13, 2:21:16]: Cool. That's all I have. Okay. Any other questions from the board? [2:21:17, 2:21:18]: Thank you. [2:21:21, 2:21:30]: With that, I'd like to open it to the community. So if you would, if you are in favor of the application, please form a line to the left. [2:21:32, 2:21:40]: If you are opposed to the right, make sure you sign the sheet. When you come forward, please speak into the microphone, state your name and your address, please. [2:21:45, 2:21:57]: Good afternoon. Can you hear me? Yes. I live at my name is Lawanda Detman and I live at two fifty Brandon's Walk. This development is literally in my backyard. [2:21:58, 2:22:18]: I oppose it. A hundred vehicles in that space. The Highway 42 traffic is already a nightmare. When I come home in the afternoon just to go from Eagles Landing and Highway 42 up to Brandon's Road, sometimes it [2:22:18, 2:22:23]: It takes twenty five it's just bumper to bumper to bumper. [2:22:25, 2:22:45]: The schools are already overcrowded and saturated. This development will do nothing to this area but make it worse. I don't see this making a benefit in no type of shape, form, or fashion to piggyback. [2:22:45, 2:23:05]: on what other people have been saying. These price points will literally go to people, investors, who will buy these properties up and this area will become transit. Even the gentleman who was presenting stated, this is a nice area and we want to keep [2:23:04, 2:23:24]: It that way. Bringing in a hundred families who have to have schools, who have to have more stress on the hospital, who have to have more stress on the area would not be beneficial at all. I think that you should oppose this in every way. [2:23:24, 2:23:32]: Putting up a barrier on my backyard to this development will not in any way. [2:23:34, 2:23:54]: uh create a barrier for the noise that's gonna come from there. I don't know exactly where that pool or that cabana is gonna be located. It could be located right in my backyard, literally. So I oppose this 100%. And I don't think that we should even allow [2:23:54, 2:24:12]: Allow 10% rentals because once you get rentals in an area, it becomes transient. And then you get crime and you get other things that are not desirable for this area. So I beg you to vote no. Thank you. Thank you, ma'am. [2:24:15, 2:24:15]: Out of sheet. [2:24:19, 2:24:20]: I filled it out. [2:24:24, 2:24:24]: Go ahead. [2:24:26, 2:24:43]: Thank you, Mr. Vice Chairman, and I want to thank all you uh people here today that are uh doing this for us because uh I know you got a hard job. But let me start by saying my name is Ronald McNeil. I live in 259 Kensington Trace. That's in the park side at Eagles Landing that they showed on the screen there. [2:24:44, 2:24:51]: You already know that a few years ago you guys changed the pattern of traffic on Eagles Landing in forty two. [2:24:51, 2:24:57]: And it forced us no longer to be able to come out that exit and make a left turn on the Eagles Landing and go to Walmart. [2:24:58, 2:25:09]: That's cool. Progress. We love it. So we had to come out on forty uh highway forty-two in order to turn left and go to the light and make a left to go to Walmart. [2:25:10, 2:25:15]: That hidden incline coming up southbound on forty two. [2:25:16, 2:25:16]: is now [2:25:17, 2:25:19]: А main road for construction. [2:25:20, 2:25:21]: And track their trailers. [2:25:23, 2:25:24]: He says [2:25:25, 2:25:28]: Excuse me for pointing. So it's been mentioned that [2:25:28, 2:25:32]: There's no need for any traffic change because there's already a road there. [2:25:33, 2:25:34]: That's cool. [2:25:34, 2:25:36]: Only problem is like the young lady just said. [2:25:37, 2:25:38]: You can't get out. [2:25:38, 2:25:40]: At certain times of the day. [2:25:41, 2:25:43]: So we're forced to set our life pattern. [2:25:44, 2:25:46]: Based on a traffic situation. [2:25:47, 2:25:51]: I can't leave my house between four and six because nobody's gonna let me out. [2:25:52, 2:25:57]: The entrance to that neighborhood they want to build is actually a lot of times when I come out [2:25:57, 2:25:58]: In the morning. [2:25:59, 2:26:01]: A police car is sitting there. [2:26:01, 2:26:09]: Because they understand that the traffic pattern on that going up that hill, cars are racing trying to get around those tractor trailers. [2:26:09, 2:26:13]: And they're speeding, and we're stuck trying to wait to get out of our own neighborhood. [2:26:14, 2:26:15]: So I beg you. [2:26:15, 2:26:17]: Please, I bring you a solution. [2:26:18, 2:26:20]: If you tell me you're gonna build that place, fine. [2:26:21, 2:26:23]: Put a circle on Brandon Road and [2:26:24, 2:26:25]: And forty two. [2:26:25, 2:26:34]: That way those tractor trailers and trucks will not have to stop the light. They can continue on. And my exit, the only one I have. [2:26:35, 2:26:36]: To basically get out of my neighborhood. [2:26:37, 2:26:39]: Воно бі блок континуслі. [2:26:39, 2:26:42]: for ten, fifteen, twenty minutes,'cause they don't let you lay out out. [2:26:43, 2:26:46]: when they're trying to get to where they're going, headed southbound on forty two. [2:26:47, 2:26:48]: Thank you. [2:26:49, 2:26:51]: Thanks, sir. She's good. [2:26:57, 2:26:58]: Hello. [2:26:58, 2:27:05]: I'm Dan Anderson. I live at two forty one Brannon's Road, Brannon's Walk, which of course is [2:27:06, 2:27:07]: In my backyard. [2:27:08, 2:27:08]: Uh [2:27:09, 2:27:12]: They did mention a twenty five foot buffer. [2:27:13, 2:27:15]: But a twenty five foot buffer with uh [2:27:16, 2:27:17]: Two story [2:27:17, 2:27:21]: Town homes along back my back yard is [2:27:22, 2:27:26]: Зновура квает нейборгуд. [2:27:27, 2:27:30]: We like it quiet. It's not crowded. [2:27:31, 2:27:32]: And uh [2:27:32, 2:27:36]: That's that's all I've got to say. Thank you. Thank you, sir. [2:27:40, 2:27:45]: Good evening. My name's Brenda Woods and I live at two forty five Brandon's Walk. [2:27:46, 2:27:55]: which is in the cul-de-sac at the top of Brandon's Walk Road, and my property backs up to the proposed area of the building. [2:27:56, 2:28:00]: And for I have lived there for twenty six years. [2:28:00, 2:28:08]: In all those 26 years, I've had one incident happen at my house where somebody got into my husband's car and took some stuff out. [2:28:09, 2:28:19]: My fear is that bringing a hundred new homes to my backyard is going to cause crime coming to my back door. [2:28:21, 2:28:21]: I mean [2:28:23, 2:28:24]: The noise from a hundred [2:28:25, 2:28:38]: People living back there, the music, people hitting their car locks five times to make sure they're locked. Um car alarms could be set off at out all hours of the day and night. [2:28:38, 2:28:42]: And when they build, they'll cut down those trees. [2:28:42, 2:28:48]: Which will make the sun beam beat down into my windows and raise my electric bills. [2:28:49, 2:28:50]: Um [2:28:51, 2:29:00]: Most of the time I've lived back there, there's been nothing back there. Many years ago, they talked about putting a um office building. [2:29:01, 2:29:06]: Which I'd much rather have an office building back there because there wouldn't be people back there twenty four seven. [2:29:07, 2:29:25]: You know, there's gonna be lights probably from the street lights, the the houses, the noises coming, especially if there's a playground and a swimming pool. And of the seven houses that are at the top of that cul-de-sac, in that cul-de-sac, over half of us are senior citizens. [2:29:26, 2:29:30]: And one of the houses just sold. We have no clue who's moving in. [2:29:31, 2:29:32]: But [2:29:33, 2:29:41]: That was listed as being in a nice, peaceful, quiet neighborhood, which, if a hundred townhomes are built, [2:29:42, 2:29:45]: Next to us it's not gonna be nice and peaceful anymore. [2:29:46, 2:29:51]: And it's gonna cost me not only in electric bills, but if that's built. [2:29:51, 2:30:11]: I'm gonna have to change my curtains because wildlife doesn't care that I have sheer curtains or half curtains in my the back of my house, but I'm not gonna want people looking in my windows. And I go out on my back deck now, you hear the wildlife, the birds, the the crickets, the cicadas and everything. [2:30:12, 2:30:17]: I'd much rather hear that than a bunch of people back there, you know, partying or [2:30:18, 2:30:23]: just daily life. So it's gonna come out of my pocket. [2:30:24, 2:30:27]: And I don't think the fence that we have back there, the gate. [2:30:27, 2:30:39]: My husband put a um like a barn style door that slides. I don't think there's any way we could lock that fence. So if I have to change that, that's gonna come out of my pocket. [2:30:40, 2:30:53]: And I would think if they do build, I'd like to see them have to put a buffer like what's on the side of the highway to keep the noise and the light down. [2:30:53, 2:31:01]: And it's like I like my quiet, safe neighborhood. I don't need to have a hundred people in my backyard. Thank you. [2:31:02, 2:31:02]: Thank you. [2:31:07, 2:31:12]: Good evening. My name is Demetria January. [2:31:12, 2:31:17]: Um, I live at eight twenty five Rock Lane. I live in Lakeside at Eagles Landing. [2:31:18, 2:31:38]: And um I'm also the treasurer of our HOA. Um, I had my house built 20 years ago, and the main reason I had it because of the quote unquote Eagles Landing area, the prestigious Eagles Landing area and the country club. And the reason why I'm standing here today to oppose [2:31:38, 2:31:38]: Biz. [2:31:39, 2:31:40]: Um [2:31:40, 2:31:46]: building of these town homes. Um, I'm already having problem trying to get out on East Lake. [2:31:47, 2:31:50]: With the traffic coming in and with these one hundred [2:31:50, 2:31:52]: Townhouses being built on forty two. [2:31:53, 2:31:54]: That's gonna create more traffic. [2:31:55, 2:31:56]: And as you know that [2:31:57, 2:31:59]: You have Echo, the school. [2:31:59, 2:32:06]: And people know how much traffic is on 42. Not only that, but it's so much traffic when there was an accident on 75. [2:32:07, 2:32:10]: Where all the traffic get route to forty two. [2:32:10, 2:32:17]: So with him saying that no need for anything to be done with forty two or anything. [2:32:17, 2:32:37]: I think we should oppose this. It's just too much congestion or anything like that. And we don't and we really don't need town homes in that area. Um we value our property. We value the Eagles Landing Country Club, the community area. And I just think that by building tone homes and with them coming out on 42, it will be a setback for. [2:32:37, 2:32:47]: for the area. So I just wish you would consider um what I'm saying and um opposed to building up the town homes. Thank you. [2:32:48, 2:32:48]: Thank you, ma'am. [2:32:51, 2:32:51]: Anyone else? [2:32:54, 2:32:54]: Yeah. [2:32:55, 2:32:56]: With that, yes, sir. [2:32:58, 2:32:58]: Yeah. [2:33:02, 2:33:11]: Okay, I jotted down just a few of the concerns and and and I and I do hear the concerns and um I just I wanted to address a few of'em as far as traffic goes. [2:33:12, 2:33:13]: Um [2:33:13, 2:33:29]: It is it's my understanding that Highway forty two is on the DOT's list to be widened in the next however many years that is. But uh the fact that it is on the list should provide a little bit of solace to to those uh who who live around there. But I do understand the traffic. [2:33:29, 2:33:31]: А інстаф'с репорт. [2:33:32, 2:33:38]: They did do uh they did look at the traffic impact of this um this development on the highway. [2:33:38, 2:33:51]: And in the report it does say that the average daily uh traffic on highway forty two is seventeen thousand two hundred vehicles. So our hundred vehicles a day is is [2:33:51, 2:34:00]: kind of a drop in the bucket um compared to the amount of traffic that's already on there. And the staff report does say that it would have very minimal, if any, impact whatsoever. [2:34:01, 2:34:21]: Um as far as the price point of our houses, our units, they are very comparable and even exceed some of the surrounding uh price points of the houses around us. Uh we've gone and looked at some of those, some of the houses that are for sale, the recent sales and the ones that are for sale now. Um [2:34:21, 2:34:28]: And they are very comparable, or if not more, in some some cases, uh than some of the surrounding properties. [2:34:29, 2:34:30]: Um [2:34:30, 2:34:50]: A lady brought up a question about rentals. Um we don't in we don't intend to have any rentals. I know the staff put in there a maximum of ten percent rentals. Uh we would be fine with zero percent rentals uh because we have no intentions of of doing any rentals. It is for sale only. Um and then the buffers. These uh these buffers [2:34:50, 2:35:10]: will be planted uh very heavily um to uh screen the our subdivision from the neighbor's subdivision and vice versa. Um we'll also have you know the street lights uh the way they make them nowadays are all led downlit so uh the uh the light glare is not uh [2:35:10, 2:35:22]: you know, doesn't spill over into the neighbor properties. So um hopefully that addresses just a few of the issues. I I know that probably doesn't, you know, uh answer all the questions, but uh [2:35:22, 2:35:29]: But hopefully it provides a little bit of information of of kinda where we're coming from. So you have any questions I'll be glad to answer that. [2:35:31, 2:35:32]: Questions from the board? [2:35:35, 2:35:37]: All right, thank you, Storper. Thank you.
