And whereas this year's theme, everything is possible, everything is possible for Latinos, great economic growth, innovation, competitiveness, stronger and middle class, and a set of values centered on family, hard work, opposition. Optimism. [0:07:41, 0:08:01]: Excuse me. [0:10:06, 0:10:07]: Come on up, please. [0:10:08, 0:10:28]: This next proclamation, ladies and gentlemen, Ms. Tucker is here from the Haven House, but it's this is with domestic violence. So if anybody else is is uh wants to join us for reference to domestic violence, please do so. This is a proclamation and uh how you doing by the way? Good, how are you? Oh, just fine. Domestic Violence Awareness Month, whereas domestic [0:10:28, 0:10:48]: Violence is a pattern of abusive behaviors characterized by one partner's need to control the other by using a range of tactics that can include physical, sexual, emotional, economic, psychological, and/or technological actions, threats of actions, or patterns of coercive behavior. Whereas domestic violence often starts early and [0:10:48, 0:11:04]: one's lifetime with almost three-quarters of female victims of intimate partner violence reporting they were the first victimized before age 25 and more than one in four uh vis one in four first victimized before the age of 18. [0:11:05, 0:11:25]: Whereas domestic violence must be understood as more than an individual behavior, as it's rooted in social values that place importance on the people having power over others and allows violence against women, other groups to occur at a minimal as well as or no accountability. Whereas this year's theme of domestic violence awareness month is heal, hold. [0:11:24, 0:11:42]: and center as we recognize and embrace the diverse ways that survivors and communities heal from violence and oppression. And center those most marginalized in their other efforts to end domestic violence. Now therefore I Anthony Sfor by Verse Authority Vestan Me is Mary City, Star Pridge, Georgia. [0:11:43, 0:11:53]: On behalf of city council members, Elton Alexander, Lana, Barber Cowberry, Nakisha Gannon, Afonso Thomas to hear prime proclaim the month of October as domestic violence awareness month. [0:12:03, 0:12:12]: A witness thereof I have hereunto set my hand in the great seal of city Stockbridge, Georgia, on the fourteenth day of October year of our Lord, two thousand twenty four, and I signed a proclamation along with a clear finesse hall. [0:12:15, 0:12:19]: [739.7, 750.0]: I just wanna accept this on behalf of all survivors and victims and thank the city of Stockbridge. Thank y'all so much for this. No problem, no problem. Appreciate it. [0:13:26, 0:13:28]: The next proclamation World Mental Health Day. [0:13:29, 0:13:34]: And I don't know if there's anybody here to receive this. If not, I'll continue to read it. Okay. [0:13:34, 0:13:52]: So, whereas World Health Organization recognized World Mental Health Day, October tenth of every year, this day provides an opportunity for all stakeholders working on mental health issues to talk about their work and what more needs to be done to make mental health care a reality for people worldwide. [0:13:53, 0:14:13]: Where a safe, healthy working environment can act as a protective factor for mental health, unhealthy conditions, including stigma, discrimination, exposure to risks like harassment and other poor working conditions, can pose significant risks affecting mental health, overall quality of life, and consequently participation or productivity at work. [0:14:13, 0:14:18]: Whereas it is essential for government's employees, employers, the organizations which represent workers and employees. [0:14:18, 0:14:24]: and other stakeholders r responsible for workers' health and safety to work together to improve mental health at work. [0:14:24, 0:14:29]: Whereas World Mental Health Day is a chance to talk about mental health in general. [0:14:30, 0:14:38]: how we need to look after it and how important it is to talk about things and to get help if you are someone who know is struggling. [0:14:38, 0:14:43]: Stigma and discrimination continue to be a barrier to social inclusion and access to the right care. [0:14:43, 0:15:03]: But we all play our part in increasing awareness about such preventive mental health interventions work. Now therefore I Anthony S. Ford by virtual authority investor in me as a mayor, C of Stockbridge, Georgia. Now on behalf of City Council members Elton, Alexander Yulana, Barber John Blount, Lakisha Gantt, and Follow Thomas do hereby proclaim October tenth, twenty twenty-four. [0:15:03, 0:15:23]: As World Mental Health Day in the city of Stockbridge, Georgia, and we encourage everyone to show your support in making mental health a priority in our community, wear your green ribbon in support. [0:15:23, 0:15:31]: I'll clarify now. So how are they? Okay, I'm sorry, she's back. [0:15:31, 0:15:40]: Okay, fine. Oh no, fine. Would you read comments you you want to return anything? [0:15:41, 0:15:56]: Good evening. As a member of the stepping up committee here in Henry County, I received this award, knowing that we're working toward making sure everyone has an opportunity for a healthy life, mental health, spiritual health, and a wholesome life. Thank you. [0:15:56, 0:16:04]: Okay. [0:16:05, 0:16:05]: [972.2, 974.1]: Thank you. All right. [0:16:15, 0:16:18]: Okay, absolutely appreciate it. Thank you very much. All right. [0:16:20, 0:16:21]: Okay, miss something. [0:16:25, 0:16:26]: In this one though. Mm-hmm. [0:16:27, 0:16:28]: Well yeah. [0:16:31, 0:16:36]: We okay. So what is what is it? Okay, what well what it is is that um [0:16:37, 0:16:57]: Red Ribbon Week and uh has here some school pr anybody from the educational principals here, okay. And uh breast cancer awareness month um is what I have here and I have a name of Rachel Jones and is okay, she's not here to at point. Now, um [0:16:57, 0:17:00]: And I [0:17:00, 0:17:06]: Hardy, I see you, sir. And for I know that come on up for a second. Please come on up, Hardy. [0:17:12, 0:17:32]: Ladies and gentlemen, this is Hardy Abbott. He works for Vijestar. Come come on over here, Mr. Micr. This works for Vijestar, which is in our community. It's on uh Eagles Landing Parkway. And Vijestar is actually a sponsor for uh for our amphitheater, D Bridge. All right, now the other day, just uh it was a Sunday night, just last night, we had a wonderful [0:17:32, 0:17:51]: uh concert and during that concert we actually uh uh gave the city excuse me gave five star a proclamation from the city in reference to um good good goes everywhere what's it called goods everywhere. Good goes everywhere. Right. And so what it amounts to deals with their nonprofit all the [0:17:51, 0:18:11]: And the fact that we have a real great relationship with ViceTar. They've been a lot, there's not only sponsored on Amphitheater, they've been a lot a lot of sponsors of supporting many activities here in the city of Stockbridge. [0:18:11, 0:18:19]: So happens that when I I I issued that to you, we issue a group of issued that to you, and um the proclamation that we read the other night. [0:18:20, 0:18:23]: is not here in front of me right now. Okay? [0:18:23, 0:18:43]: So I've just that's just wanna bring it up. I don't know I don't know but we you you we'll we'll make sure we issue that pack to you again, right? But I but it's not sitting right here. Uh so but I don't want to waste your time and have you sitting and wait, all right? We appreciate that. No problem. But on that note, I tried to give a small little synopsis. But if sir, if you have anything you wanna say, here's a mic for you. Please do. [0:18:43, 0:18:44]: Please do. [0:18:44, 0:19:04]: Thank you so much for having us on today. So Stockbridge was the first location of Vystar. Vistar started in 1952, Jack's Navy Federal, with five members and well, excuse me, with 12 members with only$5. So ViceTar is definitely in the [0:19:04, 0:19:24]: community and we believe that we want to do good so individuals can definitely bank better. We are excited about the partnership that we have with the city of Stockbridge as well as with the bridge. And of course we are here for the community so that we can help your friends and family succeed financially. [0:19:24, 0:19:42]: We are located at 980 Eagles Landing Parkway. So any of the financial needs that you might need some assistance with, we are excited to be able to offer you some advice and some guidance so that you can reach those financial dreams. Overall, just a really quick story. [0:19:43, 0:20:03]: My mom raised me and um my father was there too, but she was really, really, really keen on financial wellness. And of course, I was able to purchase my first home at the age of 23. So if I can do it, anybody can do it. So and I want to offer that same guidance so that everyone [0:20:02, 0:20:20]: I personally believe it's not so much if you can be a homeowner, it's just when. So I just would encourage you to come and visit us. And last but certainly not least, we've been sharing with everybody. Can't tell you who to vote for, but make sure you exercise your civic duty and vote. Thank you. God bless you. [0:20:25, 0:20:31]: Since you are a partner of Stockbridge and we'll have a long-standing relationship without a doubt. [0:20:32, 0:20:33]: Yeah, I got used to. [0:20:37, 0:20:40]: If you don't want to look forward, should put things on. [0:20:47, 0:20:52]: Thank you, Tom. Thank you. Okay, you know what? Here [0:20:53, 0:21:01]: I I need a document, sir. Just in a time. Just in a nick of time. [0:21:14, 0:21:20]: Thank you. All right. We're gonna we're gonna go through the whole thing, right? We we got time. I've got so this is uh [0:21:20, 0:21:25]: So let me let me just read this for you all. And some of the things uh let's go through this process. Good is everywhere. [0:21:25, 0:21:34]: Whereas since the founding of 1952, the Naval Air Station Jacksonville ByStar Credit Union has provided high-quality financial services to the people of Northeast Florida. [0:21:35, 0:21:44]: Whereas ViStar Credit Unit started with just twelve members and was since grown to become the thirteenth largest in the nation, now serving nearly one million members throughout Florida and Georgia. [0:21:44, 0:22:01]: Whereas a critical part of the credit union movement is commonly uh is community engagement. And last year, ViceStar provided more than 6.5 million in donations and grants to local nonprofits. ViceStar is a proud sponsor of Stockbridge Amphitheater, and our members can receive a special discount on select shows. [0:22:01, 0:22:12]: Whereas employee volunteerism and community stewardship is also central to ByStar's culture, and each year the credit union sponsors a multi-day effort across the footprint called Good Is Everywhere. [0:22:13, 0:22:33]: This initiative focused on recognizing the good that exists in the world by spotlighting local organizations that do important work each day and supporting them with volunteer efforts led by employees. Whereas in 2023, the Good Is Everywhere campaign resulted in 128 company-wide service events involving 1,360. [0:22:33, 0:22:52]: Employees, nearly 6,000 volunteer hours logged, and more than$22,000 worth of employee-led nonprofit donations. Whereas ViceTar members and others from the community will be given opportunities for free access during Good Is Everywhere to important cultural institutions that do good for our community every day, such as Stockbridge Amphitheater. [0:22:52, 0:23:12]: And whereas the Stockbridge community joins VISTAR in celebrating good is everywhere in 2024 and recognize the impact of VISTAR and other credit unions to continue to have our residents' financial wellness and region's economic development. Now therefore, I Anthony Sforbivers Authority Invest in Me is the mayor of the city of Stockbridge, Georgia. On behalf of city council members Elton Alexander Lonabarbara, [0:23:12, 0:23:16]: Cowbury, Lakese again, and Fonzo Thomas do hereby proclaim [0:23:16, 0:23:36]: Sunday, which was yesterday, October 13th, 2024, Good Is Every Day, every excuse me, Good Is Everywhere Day in the Great City of Stockbridge, Georgia, and encourage all citizens to recognize the important contributions of Vice Star Credit Union and its employees in both our business sector and our community as a whole. A witness thereof, I have hereunto sat my hand in the great CLC. [0:23:36, 0:23:46]: Stockbridge, Georgia, on the thirteenth day of October, year of our Lord, 2024, and I signed a proclamation along with our clerk for Nessa Holiday. There you go, sir. Thank you. [0:23:47, 0:23:56]: All right. So unless you want yeah we're going to want much yourself, that's what that's why I get I got called at it too. Let's just go ahead and just take a picture with this as well. [0:24:05, 0:24:10]: Thank you. Thank you, Kyle. No problem. No problem. Thank you. [0:24:12, 0:24:13]: Okay. [0:24:16, 0:24:17]: Rachel Jones. [0:24:20, 0:24:22]: Any uh school principal sis Barnes or Stockwood Elementary? [0:24:26, 0:24:30]: Uh breast council awareness. Anybody here for breast council awareness? [0:24:34, 0:24:36]: Alrighty. Well [0:24:39, 0:24:43]: I I know we're gonna find out. It's a second. We're gonna wait a bit and see who this is. [0:24:44, 0:24:50]: No, that's not that's that's our employee. Uh huh. That's our employee. [0:24:50, 0:24:54]: All right, so Red Ribbon Week, twenty twenty four. [0:24:56, 0:25:16]: All right, so this deals with uh where substance issues uh affect individuals, families, and communities across Henry County, Center Georgia, and the nation. Whereas an imperative that communities launch visible, unified prevention education to eliminate the demand for drugs. Whereas the National Red Ribbon campaign offers citizens the opportunity to demonstrate their commitment to drug-free. [0:25:16, 0:25:36]: free lifestyles, no use of illegal drugs, no illegal use of legal drugs. And the National Red Ribbon campaign will also will be celebrated in every community in America during Red Ribbon Week, October 23rd to 31st, establish the theme of Life is a movie, film drug-free. [0:25:36, 0:25:56]: And whereas business government parents, law enforcement, media, medical institutions, religious institutions, schools, senior citizens, service organizations, youth will demonstrate their commitment to healthy, drug-free lifestyles by wearing and displaying red ribbons during a week-long campaign. Now, therefore, I Anthony Forbes, but virtual authority invested in me as a mayor of city. [0:25:56, 0:26:16]: Stockbridge, Georgia, and on behalf of City Council members Elton, Alexander, Yolanda, Barber, Kyle, Berry, Akese Gann, and Afonso Thomas to hereby proclaim the week October 23rd to 31st as Red Ribb in Stockbridge, Georgia, and encourages all stakeholders to participate in drug prevention education activities not only during Red Ribbon Week, Red. [0:26:16, 0:26:17]: Ribbon week. [0:26:18, 0:26:27]: but also throughout the year making a vi visible statement, Bible a visible statement, that's right, that are strongly committed to drug free schools. And witness thereof I have hereunto set my hand [0:26:27, 0:26:36]: Ratio stop race, Georgia on the 14th day of October, year of our Lord, 2024, and assigned the proclamation law on a prayer for Ness Holiday. Okay? All right. [0:26:36, 0:26:48]: So I don't know if the council wanna make any comments and reference this at all. Okay, okay. Alright, just I'll I'll figure out. Okay. [0:26:49, 0:26:50]: Good. [0:26:59, 0:27:01]: No question about this. [0:27:05, 0:27:05]: Right. [0:27:11, 0:27:14]: Okay, once again breast casting awareness. Anybody here to receive this proclamation? [0:27:14, 0:27:24]: If anyone who uh related to someone that lost to battle with the rest cancer or survival to give some other support, awareness and education. The other one was portable service from other Georgia municipal municipalities. [0:50:31, 0:50:46]: Towards the twenty years uh of service can be allowable. And what that meant is that police officers need to be in service with Stockbridge in order to meet this requirement of fifty-five years, fifty-five years of age and twenty years of service. [0:50:47, 0:50:50]: And if they have any service with another municipality. [0:50:50, 0:50:55]: that service is portable. [0:52:30, 0:52:35]: This was one of the budgetary items that was listed on the um [0:52:37, 0:52:56]: Office of Planning and Budget Safety Community Violence Reduction Grant that was approved by Council back in August of twenty twenty-three. This is a sole source purchase. This will come from general funds temporarily. Once the purchase is made, we will submit and do a drawdown and reimburse the city for the full amount. [0:52:57, 0:53:02]: Uh thank you for that. Council, any questions for assistant chief? Go ahead, uh Mr. Thomas. [0:53:03, 0:53:05]: Uh assistant chief. Yes, sir. [0:53:05, 0:53:06]: That sounds pretty good. [0:53:07, 0:53:08]: Yes, sir it does. [0:53:08, 0:53:09]: Just wanna [0:53:10, 0:53:14]: I wanna thank you for the presentation and I was reading over this uh [0:53:15, 0:53:20]: over the weekend and I had a c concern and a question. I know this is um [0:53:20, 0:53:23]: You indicate it's coming from the general fund. [0:53:24, 0:53:30]: Um and it's going to be reimbursed to the city. [0:53:31, 0:53:33]: Uh but my question though is [0:53:34, 0:53:39]: Uh, since this is coming from the general fund, I was trying to identify [0:53:40, 0:53:43]: uh the line item exactly where the funds were actually coming from, so [0:53:44, 0:53:54]: if misses uh Gaines could come forward, maybe she can share some light with me'cause I was trying to get a better understanding. Uh I I think it's always good that [0:53:54, 0:54:01]: Uh the Stockbridge Police Department is uh building itself up to be able to do the work here in the city. [0:54:01, 0:54:08]: But I'm always concerned about the the finances and and actually where we're actually pulling it from and [0:54:08, 0:54:20]: I would have liked to have known uh in advance exactly where it was coming from, but well even that with that being said, maybe uh Mrs. Gain can can shed some light on that for evening, Mayor and Council. How are you? All right, evening. [0:54:20, 0:54:38]: So the two hundred and seventy seven thousand dollars in question would basically just come from the general fund. Um we'll do a budget adjustment if approved. And once the purchase had been made and we have an invoice, we'll immediately do what Mr. Godfrey said, which is a drawdown, and those funds will be immediately reimbursed to us. [0:54:39, 0:54:42]: Well, I I do understand that part'cause it was mentioned but [0:54:43, 0:54:45]: Um the line item. [0:54:46, 0:54:49]: Out of the general fund, can you identify the line item? [0:54:49, 0:54:50]: Yes, sir. You want me to give it to you now? [0:54:51, 0:54:51]: Yes, please. [0:54:52, 0:54:53]: One zero zero. [0:54:53, 0:54:54]: One zero [0:54:55, 0:55:00]: Go ahead. Zero zero uh five zero zero zero zero zero zero. [0:55:00, 0:55:01]: Okay. [0:55:02, 0:55:03]: And then it will be three zero. [0:55:04, 0:55:06]: Three zero. One zero zero. [0:55:06, 0:55:17]: One zero zero. So that's one zero zero zero zero zero three zero one zero zero. That's the line item. An additional zero, I'm sorry. [0:55:17, 0:55:21]: At the end. And that's the line item. Yes, sir. Thank you so much. [0:55:22, 0:55:29]: Any other quest is that is that all, sir? Yes. Okay, anything else from the council? Okay, no question any motion to accept this, please? [0:55:29, 0:55:31]: Okay for Ms. Alzheimer's a second. [0:55:32, 0:55:35]: Okay, o okay, Mr. Berry, all in favor, please in the K. [0:55:36, 0:55:39]: Thank you very much, gentlemen, ladies. Okay. [0:55:41, 0:55:52]: Council consideration adopt the ordinance to approve the job description organizational chart and pay and classification for the newly created position tax property tax specialist. Miss Gaines and Miss Wheeler, please. [0:55:55, 0:56:15]: Hi, Council. We've submitted a job description for the property tax specialists. And just to detail it, the uh the position will work closely with Mr. Cook over at Henry County. And we'll once we receive all the applications, they'll be reviewed. We'll compose the documentation that they set forth for us. [0:56:14, 0:56:20]: us and relay that information over to Cook County. I'm sorry, Henry County. [0:56:22, 0:56:28]: And they'll do other duties as assigned by finance as well. Year in close, month in clothes, but [0:56:28, 0:56:29]: Mm. [0:56:29, 0:56:35]: The homestead exemptions and collection of the property taxes will be the main ps responsibilities of this position. [0:56:37, 0:56:41]: All right, council, any any questions? Thoughts? Go ahead, Ms. Gantt. [0:56:41, 0:56:46]: So if we have our own properties tax specialists, why are we paying [0:56:47, 0:56:48]: The [0:56:49, 0:56:50]: Uh [0:56:50, 0:56:52]: Henry County Tax Commissioner. [0:56:53, 0:56:58]: a fee. Like what are we doing with our own? Uh aren't they collecting the taxes and [0:56:59, 0:57:02]: And doing all of those things that you're describing here in the job description? [0:57:04, 0:57:09]: They do not handle our homestead at all. They just collect the taxes and then [0:57:10, 0:57:17]: distribute them to us, but it's our responsibility to approve andor deny homestead exemptions. It's also our responsibility to keep [0:57:18, 0:57:21]: A tally of delinquent taxes and unpaid taxes. [0:57:24, 0:57:44]: You wanna expound on that? It's you're saying it's our responsibility. Tell me wha what is Michael Harris's responsibility? So under our um forty nine agreement, they collect our taxes as part of that agreement. Um but there is a state law that requires that if you do homestead exemption, this is what I was talking about. [0:57:44, 0:57:47]: We have to be responsible for the exemption side that was not covered. [0:57:48, 0:57:59]: And there's he told me that there's a specific state law that guides that. So for everybody to do homestead exemp that those communities to do homestead exemption, they required for actually handling that side of the house, not not Henry County. [0:58:01, 0:58:10]: And that's the reason why. This was we discussed this at the retreat, and I remember telling y'all that this was coming because of that requirement that that Michael Harris told us about. [0:58:10, 0:58:16]: And that we needed to get ahead of it obviously to make sure that we have somebody in place to be able to do the homestead exemption side of the house. [0:58:16, 0:58:17]: They were not [0:58:17, 0:58:19]: contracted to do that. [0:58:26, 0:58:27]: But they get a V. [0:58:28, 0:58:40]: Bigger percentage. Um I I I uh we we talked about that and uh he was specific and asked to read that's the only reason why this is before you because we had that conversation with with um Mr. Harris. [0:58:42, 0:58:42]: Okay. [0:58:44, 0:59:04]: Any other questions from the council? Yes. Go ahead, Mr. Bear. So additionally, um, we talked about this position is based upon the election as well, whether or not that is ratified. Yes, sir. And so in the event that it is not, what if we approve this position tonight, what is the conclusion of [0:59:04, 0:59:12]: What we ratify here on council for this position in the event the citizens don't approve the homestead. How would we handle that? [0:59:13, 0:59:33]: We're still responsible for tracking our delinquencies and the position would also help with other financial responsibilities, open records requests, um year-in closing, just finishing out things that are needed for finance. So in the event of the election, we will rename it something else. We would have to come back and rename the position. [0:59:33, 0:59:40]: That's what I wanted to get. Yeah. You know, not more than fifty percent of the job duties are going to be collecting [0:59:40, 0:59:57]: or doing the homestead exemption, which would be a large part of the physi position's job. So we'll have to come back to you all, reclass the position to something else and for those new duties or remove the majority of the duties and add new duties to the position. [0:59:57, 1:00:04]: Right, because we also have some other carryover. Okay. Yes, sir. All right. Thank you for clarifying it for me. [1:00:04, 1:00:05]: Any other questions from the council? [1:00:07, 1:00:10]: All right, then I just need a motion to accept this uh new job description. [1:00:11, 1:00:15]: Is there a second? Mr. Burr from Malazander. Mr. Berry, are all fair, please in the K. [1:00:17, 1:00:22]: Oppose? You oppose okay, three three one, it passes. Miss Gann opposes. Okay, thank you, ladies. [1:00:24, 1:00:26]: What's next, ladies and gentlemen, is a public hearing. [1:00:26, 1:00:28]: Let me read the rules for public hearing. [1:00:30, 1:00:40]: Okay, please mute all cell phones and electronic devices. Anyone wishes to speak tonight on a public hearing item, please fill out the form available on the table and hand it to the city clerk before approaching the podium. [1:00:41, 1:01:01]: After each case is called, the council will hear from the city staff, followed by an applicant or representative regarding the proposed plans for property along with or any relevant information. The council will be free to ask questions at any time before the vote. Following an applicant, anyone who wishes to speak in favor or opposed to the case will have the opportunity to do so. Please note that these hearings are not a debate. [1:01:41, 1:02:01]: Fair to comply will cause you to be removed from the chamber and the building by law enforcement if you deviate from the proceedings. Other than the applicant, no person may speak more than once. The applicant may reserve part of his or her speaking time as a rebuttal and may speak next and last and may use the entire ten minutes allowed for the pro side of the [1:02:01, 1:02:18]: If questions are raised, the council may ask the applicant to address questions and or concerns. The presiding officer will call for the motion and a second to the motion and have any unnecessary discussion. If the matter is not tabled, the presiding officer will call for the vote to recommend approval or denial of the request. [1:02:21, 1:02:35]: So now we're in a public hearing, it's now open. Number nine, rezoning case RZ2024-07 for the Patrick Henry Parkway Master Plan located in Council District 5. [1:02:35, 1:02:55]: Consideration of the Patrick Henry Parkway master plan, which is prepared by the TSW Consulting Firm, it proposed a mixture of retail, commercial, residential, and entertainment uses for areas along the southern end of Patrick Henry Parkway, with some properties lying within the city's stopper city limits, and others lying within uh inaccorporated Henry County. [1:02:55, 1:02:58]: And this evening is be presented by Mr. Gardner, please. [1:03:00, 1:03:02]: Good evening, Mayor and Council. Evening, sir. [1:03:10, 1:03:11]: So [1:03:12, 1:03:18]: Tonight I'm gonna kinda give you guys a overview of how we got here and then I'm gonna let staff handle the technical side of it. But [1:03:18, 1:03:27]: This was an initiative that started and uh out of the city manager's office to look at how do we master plan this corridor that's within the city limits. [1:03:27, 1:03:33]: Um specifically not waiting until we have requests for development to come in, but guide. [1:03:33, 1:03:53]: that development. And this was an effort that spend going on going for over a year, working with the property owners and the property owners repres represent representatives within that area to sit down with our land planning firm and look at how do we make this uh corridor one of the most unique corridors [1:03:53, 1:04:13]: Not only in the city of Stockbridge and Henry County, but for the first time to have a vertical mixed use project on the south side of Atlanta. And those property owners were on board and their representatives were engaged in the process and be able to come up with a master plan for the Patriot. [1:04:13, 1:04:20]: Patrick Henry Corridor and the owners of the properties in conjunction with another developer who [1:04:21, 1:04:26]: Um has been integral in changing the landscape in the Jodica Road Corridor, Mr. Jeff Grant. [1:04:26, 1:04:29]: Um assisted with facilitating [1:04:29, 1:04:31]: Um the ownership on the corridor. [1:04:32, 1:04:33]: And um [1:04:34, 1:04:39]: We came up with this master plan and so part of that agreement was we would rezone the property. Um [1:04:41, 1:04:44]: to guide the development within this area. And so you have a [1:04:45, 1:05:05]: on your screen. You should have a the map of that corridor. Uh I will say that the apartment complex to the north uh of we've discussed in exe uh in executive session that portion of the corridor is going to change. Um so we will not be probably on those [1:05:05, 1:05:12]: Those apartments. Um, those apartments will go away, but this majority of the property will be developed as as designed. [1:05:12, 1:05:32]: Um spoke with the representative of the land ownership below Holloway and they'll be submitting an annexation because that's the part that we don't control. It's still in the county. But uh Mr. Patel has agreed and will fill in the application and submit it to our planning department to annex that portion so we will have that whole corridor uh in the city, except for the piece where the [1:05:32, 1:05:52]: The senior homes is being built right now. It's just still in the county. That's the only portion that's left in unincorporated Henry County. And so with that, I'm gonna let the staff come in if you guys want to go through anything. But mostly what you have is a mix of residential, multifamily, single-family. [1:05:52, 1:06:12]: family attach, um, residential above, uh retail, retail, uh, and there's a few office spaces as part of the development. Um there is an LOI for a specific use in that area where the apartments is going that was signed um by the landowner and the entity. [1:06:12, 1:06:22]: Um and there's another verbal L O I for a luxury car dealer to come in on a portion of s a portion of this property as well. Um [1:06:22, 1:06:27]: So with that, I think the staff we presented this to the planning commission about a month and a half ago. [1:06:27, 1:06:38]: Uh it came back before the planning commission. They voted to approve it and s staff recommends approval of this. [1:06:38, 1:06:44]: I'm gonna give that quick overview and I didn't write the staff report, so I'm gonna let the staff kinda go through the staff report with you. [1:06:52, 1:06:52]: Okay. [1:07:06, 1:07:10]: Well, we'll entertain any questions you guys may have. I mean I think council is aware that this has been coming. [1:07:11, 1:07:17]: Yes. Well we'll imagine I'll uh I'll let Mr. Azan since it's his district, I imagine he has a few questions. Que answer. [1:07:18, 1:07:38]: Well, first of all, Mr. Gardner had engaged me during the process and we had discussed um the specifics behind this and the desire to attract the type of businesses that the community had desired so they don't have to leave their community to work, eat. [1:07:37, 1:07:57]: shop and to work. And this development provides the first real opportunity for that to happen. And in partnership with the entities and with the letter of intent, these are some businesses that people would, if they understood who they were, would really be very excited and understanding. [1:07:57, 1:08:17]: Understand some of the businesses that they have desired now have an eye on Henry County because of the excellent work the staff has done in coordinating this. This determines so that when somebody comes here and says to us that we uh this is what we want. The city manager was proactive in going to them and saying, [1:08:17, 1:08:37]: This is what we want up front in coordination with myself and the businesses, and you all as well have been tapped into what has been going on here. And this project offers us an opportunity to do some other things in terms of infrastructure as far as widening Patrick Henry Parkway in the future, uh having a [1:08:37, 1:08:57]: a 10 foot multi-use path to put together a walkable and golf cart area uh in there so that one day that uh produ that residents will be able to leave and enjoy and connect the uh Eagles Landing Parkway area to uh the Jodica area via uh golf cart. [1:08:57, 1:09:17]: be a scooter or uh alternative transportation as well as connecting to downtown uh in the overall scheme of things. But this is one of the highest quality development standards in all of Georgia. Is that correct, Mr. Gardner? [1:09:17, 1:09:37]: gonna set some high. I said one of the one of them, yes sir. It'll be one of the right. Yes sir. We're gonna say that'll be one of the that's what I'm saying. Obviously uh it depends on what the end users are, but it'll be let's let me rephrase that. It will be one of the highest standards in Georgia. That is correct. Absolutely. So that was our goal to be [1:09:37, 1:09:57]: uh in the top tier uh with this development so it would uh reflect what the community had desired because we had a number of years ago we had a number of charretes that we had people come to to say what type of buildings that they want to uh have in the community and all of those are reflected uh in this particular development. [1:09:57, 1:10:12]: along Patrick Henry Parkway. And again, the b the grand plan offers us an opportunity to do what is needed to be done, which is expanding and widening Patrick Henry Parkway along this corridor in coordination with mister Berry's district. [1:10:12, 1:10:32]: When Rock Cory Road is widening, this will offer great transportation between those two areas where you'll be able to go uh from Jodico Road all the way to North Henry Boulevard on the improved infrastructure and traffic. And then on the other side of 75, you know where they're going with the Hudson Bridge Road to Jonesburg. [1:10:32, 1:10:52]: Road connector. So we'll have one of the best infrastructure and transportation corridors, two of them, right here in this area, and that will allow us to be able to compete, to keep our citizens and to bring good jobs to this area. [1:10:52, 1:10:56]: area. Right, sir. Yes, sir. And and I'll expand on that. Um [1:10:57, 1:11:01]: Recently I was contacted by the development devi approved I think over a year ago just north of this. [1:11:02, 1:11:07]: Uh and they want to be a part of this synergy uh in terms of the Patrick Henry corridor and [1:11:07, 1:11:25]: So as they're going they're gonna be coming for their land planning process to see how they could connect to what we're proposing here, not only through the ten foot wide path, but into development, mm, how we could connect so that those folks don't have to get on Patrick Henry to get down to enjoy the entertainment and the [1:11:25, 1:11:45]: lifestyle choice that that we're gonna develop here. I will also say that I'm looking forward to moving on the other side and meeting with those landowners and doing the same thing there so that we can s seriously plan out these areas, being proactive rather than reactive to zoning requests. We're proactive in terms of what we want to see. And so when those entities come, [1:11:46, 1:11:59]: Those owners go out and they meet with developers. They already know what's being what's planned for the area. And so there isn't a lot of back and forth between us and them because we've gone forward with the landowners and land planned ahead of time. [1:11:59, 1:12:00]: Outstanding. [1:12:01, 1:12:20]: Ms. Gann, I think you have something on you wanted all your mind. You good? All right, gentlemen down here. Anybody? You all good? All right. Well I uh Ms. Alexander, you put a motion in in place? Yes, sir. The staff has recommended approval of this measure for the Patrick Henry Parkway master plan, and I make a motion to approve. [1:12:20, 1:12:31]: I second. Okay. I think you gotta open it to the public. It is a is a rezoning search. Okay, yeah, yeah. You know what? Thank thank you. Normally no I'm glad you caught it. Normally the clerk's got it. Clerk you didn't [1:12:31, 1:12:33]: Yeah, yeah. [1:12:34, 1:12:44]: I d Thank you. I'm tell I'm sorry, I'm jumping the gun. Thank you. All right. All right. It is a public hearing. [1:12:44, 1:12:51]: All right, so uh comments. Anybody that has comments four. Uh my far uh my far left side, anybody have comments four? [1:12:52, 1:12:54]: In the middle. Anybody has comments four in the middle? [1:12:54, 1:13:08]: Anybody have comments for and on my far right? Anybody have comment have comments against this particular development in my far left? Against in the middle. Anybody in the far right? Against comments against this project. Okay. That part of this uh [1:13:08, 1:13:14]: Public hearing is closed. Okay, now on that note, now Mr Alexander, please. [1:13:14, 1:13:19]: I make a recommendation to approve the Patrick Henry Parkway master plan recommended by staff. [1:13:20, 1:13:24]: I second. Ms. Can't second that all favor, please indicate. Thank you very much. There we go. [1:13:25, 1:13:45]: Thank you, City Manager, for that. Thank you. All right. City of Stockbridge 2025-2029 short-term work program capital improvement element. STWP slash C I E. The Community Development Department is requesting that the City Council approve. [1:13:45, 1:14:05]: The transmittal of the 2025-29 2029 short-term work program capital improvement element STWP slash CIE to the Department of Community Affairs and Atlanta Regional Commission for the review and recommendations. Mr. Anderson, please. All right. Good afternoon, Mayor and Cameron. [1:14:04, 1:14:05]: Also uh [1:14:08, 1:14:28]: Uh what staff is presenting tonight is the um twenty twenty-five to twenty twenty nine capital improvement short term work program element asking for mis permission for the mayor to be able to transmit um the package to the ARC for review. So um son of [1:14:30, 1:14:34]: Here's the um on the screen is a copy of the letter. [1:14:34, 1:14:40]: That the mayor will will be actually signing and um that it goes along with the package that we will be transmitting. [1:14:40, 1:15:00]: Mr. Ryan, I just got I did sign this when I came in today. I signed it and I gave the copy to Ms. Rawl. So she has a signed copy for you. Okay counsel here signed copy for you. Okay. All right. Thank you. All right, so this is a copy of that letter, uh, so everyone can see. Uh here's the the um the copy of the uh resolution. [1:15:03, 1:15:19]: uh uh authorizing transmission and um last this is the copy of the um short term work program itself uh list of new projects projects that are underway and uh completed projects [1:15:20, 1:15:25]: So here's the uh list of projects under the category uh community facilities. [1:15:31, 1:15:40]: So there's a total of 31 projects with a grand total of$58,470,765. [1:15:43, 1:15:53]: Here is a list of uh projects under the category of economic development. For a total of 220,000, there are four projects. [1:15:55, 1:16:01]: And land use uh this is follows on the the community development department. Um [1:16:02, 1:16:17]: We have uh six projects for a total of uh one million dollars. Transportation, which is under the auspices of the Public Works Department. Uh they have four major projects totaling fifteen million five hundred thousand dollars. [1:16:24, 1:16:27]: And here's the list of completed projects over the years. [1:16:29, 1:16:39]: And uh the total of our completed projects total forty six million nine hundred and fifty three thousand eight hundred and eleven dollars. And that's the presentation. [1:16:39, 1:16:40]: All right. Thank you. [1:16:41, 1:16:43]: Council, any questions for Mr. Anderson at all? [1:16:45, 1:17:05]: Go ahead, sir. So I just will always like to when you go over this so people understand. A lot of times folks will say, well, where did this come from, or where did that come from? This is the plan, right? Yes. When we go about when the amphitheater came about, uh, when the cultural arts center is going to come about, uh, when the uh national [1:17:05, 1:17:25]: Now it's the multi-generational recreation center. Instead of saying youth center, I think that sounds better. In terms of where we're going, all of that is in our work plan. And we have to make sure that those items are included in this plan, correct? Yes, correct. So we have uh again on the spLOS, voters will have the opportunity. [1:17:25, 1:17:45]: Opportunity to vote on the multi-generational recreation center. There's$10 million that's on that SPLOST. If voters vote yes, we will have$10 million to build the recreation center that we had designed by TSW and such projects as that. We just reviewed the master. [1:17:45, 1:18:05]: parks plan and we saw some amazing things, especially over in Memorial Park, uh in Clark Park, Gardner Park, and then we have a new park coming in Mr. Gar Mr. Berry's district over there on 12 acres that we'll have money to pass if vote is so determined. We can't tell you how to vote here. [1:18:05, 1:18:25]: We just advise you what the case may be. But all of those are included in this work plan that we're working up to make sure that we uh have listed all of these projects because Park Master Parks plan includes the projects that I've already mentioned here. Yes. So what we're doing is we're systematically [1:18:25, 1:18:45]: Putting the steps together and explaining to the region what we're going to do. And then because anything that we expect to do needs to be in this plan if we're gonna apply for a grant or some type of assistance that's required, right? Yes, sir. That's exactly what's required. So anybody looking to see what's coming next or what [1:18:44, 1:19:04]: What we're going to do, they need to look no farther than this plan right here to understand if we want any financial commitments for other entities or grants that it must be listed in this plan, just like the amphitheater was listed in this plan before it was completed, and several other projects, the East Atlanta Road Project was included, several others that we've included. [1:19:04, 1:19:10]: completed. So thank you. All right. Any other questions for from counsel for Mr. Ryan? [1:19:11, 1:19:31]: Everybody's good. Okay. This is a public hearing. All right. So any comments uh against this particular plan coming from the far my far left? Any comments against the plan coming from my far and from the middle? Any comments against this particular plan? Name the comments from my far right. Any comments for this particular plan? [1:19:31, 1:19:33]: plan in my far left. [1:19:34, 1:19:36]: And forward four this in the middle. [1:19:36, 1:19:40]: All right, comments positive comments in the far right. [1:19:40, 1:19:45]: Okay, ma'am, please come forward. This is uh positive comments for name and address please. [1:19:46, 1:20:06]: Um good evening, uh, Council and Mayor. Uh my name is Jocelyn Williams, 190 Banks Drive, Stockbridge, Georgia, 30281. Uh, is it any way we can get a copy? It just looks good. I couldn't I'm older, I just couldn't see it. That's that's the only coming. It looks good. I just didn't know if if it's something we could see or if it's something that we can't. [1:20:06, 1:20:14]: But I I'm positive and wanted to just give my comments for it. Thank you. Okay, thank you. Appreciate it. Um, you coming to answer that qu [1:20:14, 1:20:34]: Question there, I believe it's would it be on our website? Yes, we can provide a copy, but usually have to go through the clerk's office, do an open records request. Oh, okay. Yeah, most requests have to be official. Okay, I got you. All right. So I think that's why they're talking right now. So you give it the details for that. Okay. Open records request, and obviously that's I guess that's what you all discussed. Okay. All right. If for no other comments from [1:20:34, 1:20:44]: from the uh from the community then aspect. I'll close that portion. Oh he don't have to that close that portion. And so now I need a emotion uh council to approve this. [1:20:45, 1:20:46]: Well here might [1:20:47, 1:20:58]: So moved. Oh, is there a second? Second. Okay, from Ms. Ganttu, Mr. Alzheimer's all favor, please indicate. Okay, so all good. Every is unanimously seized. Thank you, Mr. Anderson. All right. Okay, see here. [1:21:02, 1:21:22]: Comprehensive Plan Amendment K CP two zero two four-one, Council District five. Consideration of comprehensive plan amendment request to change the future land use designation for a property on north side of uh Hudson Bridge Road, Hudson Bridge Drive, excuse me, comprising a parcel number uh zero three two-one zero. [1:22:03, 1:22:23]: Um mayor. Yes sir. Um I would like to request that you um read the whole thing? Yes, sir. Okay. So I'll go through all the and then we'll have to we have to vote on them on individually. You realize that, right? Yes sir. Okay, so well let me read the next one then. Resulting case RZ-2024-01. Variance request two would reduce the size of the yard setbacks to the townhome lots between buildings for the required [1:24:11, 1:24:31]: 15 feet to 10 feet. The property also lies within a PMU Parkway Mixed Use Overlay District. Applicant Lanaire Georgia LLC Agent Battle Law PC. The property is located on landlock 21 of District 6 and it contains 20.367 acres. Presented once again by Ms. Anison. Okay, Miss Anison. Yours, sir. Please. [1:24:35, 1:24:45]: Uh the case of facts the mayor basically went over this. Uh the den the proposed density for the project is six point eight seven units per acre, twenty um [1:24:45, 1:24:51]: acres in total. Uh the property characteristics is currently vacant land, mostly uh wooded. [1:24:52, 1:25:12]: Uh the current future land use designation is medium density mixed use. Current zoning of the property is C2. Uh the department posted the zoning sign on July 16, 2024. Here's our aerial photo of the site. You can see it's wooded and vacant. Here's a uh aerial photo of the site with the uh [1:25:12, 1:25:13]: Site plan. [1:25:15, 1:25:16]: Okay. [1:25:24, 1:25:29]: Here's a copy of the um of the um of an aerial photo with the site plan in intertwined. [1:25:33, 1:25:35]: There's a street view of the subject property. [1:25:42, 1:25:47]: Here's another angle of the street other street view, other subject property. [1:26:03, 1:26:10]: Here's the overall uh site plan of the of the development. Um [1:26:12, 1:26:27]: The project will be comprised of fee simple town homes, twenty feet w twenty-four feet wide, uh proposed f twenty foot front yard setback and ten feet in between buildings for a total of 127 units at a density of six point eight units per acre. [1:26:32, 1:26:34]: Here's a rendering of the proposed [1:26:37, 1:26:38]: Town Holmes. [1:26:40, 1:26:42]: The elevations, the front elevations. [1:26:47, 1:26:51]: The applicant is requesting to go to medium density residential. [1:26:52, 1:27:00]: Here's a p uh a photo of the um City of Stockbridge future land use map with the surrounding uh land uses. [1:27:02, 1:27:22]: Here's the surrounding land use designation. Property to the north, you got the St. Ives apartments, St. Margaret subdivision. Both of those are high density residential. Property to the south, you got commercial uses fronting on Hudson Bridge Road, including JJ Liquor and Western Union. And also you have the Hudson Bridge Townhomes. Those are [1:27:22, 1:27:42]: Medium density residential and high density residential. Property to the east, you got adjacent uh shopping center, which is medium density uh residential as a land use. And property to the west, you got the Oakwood subdivision and the Oakwood Manor subdivision. Those are medium density residential and [1:27:42, 1:27:45]: Both of them both of them are medium density residential. [1:27:47, 1:28:07]: Uh the surrounding land use uh densities. You got the St. Ives apartments with a density rate of one unit per acre. You got the St. Margaret uh subdivision, fifty-four comprise of fifty-four units with a density rate of three units per acre. You got the Hudson Bridge Townhomes, which comprise of 13 units at a density rate of one unit per acre. [1:28:07, 1:28:25]: And the Oak Village subdivision has 45 units with a density rate of 4.5 units per acre. And you got the Oak Manor, Oakwood Oakwood Manor subdivision with 41 units with a density rate of one unit per acre. And Lanier is proposing 6.87 units per acre. [1:28:30, 1:28:41]: Uh the staff analysis after staff analyzed all the data and and uh materials that s were submitted, uh we find out we've we determined that this project is suitable for their requested um [1:28:42, 1:28:50]: For their request to go to medium density residential. So staff recommend approval for the CP, the comp plan amendment related to this project. [1:28:54, 1:28:56]: Now I'll move I'll move along to the rezoning portion. [1:29:03, 1:29:11]: The applicant, once again, the applicant is uh requesting to be rezoned from C2 to the MFR to allow for development of a townhome community with 140 units. [1:29:13, 1:29:20]: This is a picture of the city of Stockbridge zoning map. You can see that there is related uh zoning districts in the vicinity. [1:29:23, 1:29:26]: Uh here's the Parkway mixed use overlay district map. [1:29:30, 1:29:30]: Um [1:29:32, 1:29:50]: After going through the analysis, the applicant's request to be rezoned to MFR is consistent with the City of Stockbridge comprehensive plan and our staff recommended approval of the rezoning. Now I move along to the variance portion. [1:29:51, 1:29:52]: Oh. [1:29:59, 1:30:03]: Uh the applicant has submitted a request for a variance to reduce [1:30:05, 1:30:17]: The a reduction in the front yard setback of the town home lots in the MFR district from the required fifty feet to twenty feet and to reduce the side yard setbacks, uh the distance between the townhome buildings from the required twenty to ten feet. [1:30:19, 1:30:39]: Uh here's the MFR district setback requirements. It's 50 feet on the front yard, 20 feet on the side yard, and the rear yard 20 feet. The applicant is proposing 20. Uh side yard she's the applicant's proposing 10, and they meet this um the the uh current standards for the rear yard setback. [1:30:42, 1:31:02]: Uh, there are extraordinary and exceptional circumstances pertaining to this particular um property. Um and a literal interpretation of these provisions would deprive the uh applicant of rights. As a result of that, uh staff is recommending approval of both variances to reduce the front yard setback from [1:31:02, 1:31:14]: fifty feet. Instead of um twenty feet, staff is recommending thirty feet. And uh staff recommends the approval of the distance between the building from twenty feet to ten feet. And the applicant is here tonight. [1:31:15, 1:31:21]: Okay, before the applicant comes up, I wanna know Council any rent questions for Mr. Anderson right now. Go ahead, Mr. [1:31:22, 1:31:25]: Uh hold on, Mr Tom, stand by. Queen, Mr. Anside, qua. [1:31:25, 1:31:45]: Yeah, certainly the number uh that uh has been discussed and I think Ms. Bowdo's gonna update. Uh we've been working on this project, um talking about it for nearly a year now. Um there was some initial discussions, I think back in January, even before that, and certainly there have been some discussions on what was appropriate. [1:31:45, 1:32:05]: Appropriate for the community and what is not appropriate for the community. And a lot of feedback in terms of what the community wanted to see and what is actually going to actually go there. Initially the number was as high as 150 plus. That number was, as you see here, was cut down to 140. And now [1:32:05, 1:32:25]: Now the number is 127. So we're 23 down from uh where we started at, which was 150. So in working with it, uh the initial plan called for two car garage, one-car garages, and uh certainly I would was not supportive of that. [1:32:25, 1:32:45]: Two car garages on all the units. All the units now have two car garages as the part was delayed so that the adjustments could be made to the plan to remove all of the one-car garages so that we would have two car garages on all of the units to maintain the value of the area. [1:32:45, 1:33:05]: And to support that. Now, certainly we had some discussions on what was appropriate for it in terms of the community being gated versus being an open community. We had the discussions about the community, about uh traffic and transportation, and the very best. [1:33:05, 1:33:25]: News that we got was there's a$54 million road project that has just commenced. A$54 million road project that will start right there at Walmart where the McDonald's is. It will proceed south as a four-lane road as soon as you cross from the Walmart and [1:33:25, 1:33:28]: In the Bank of America you will be able to go south. [1:33:28, 1:33:47]: uh to directly to Jodico Road. You will be able to go on from there all the way to Jonesboro Road under this new four-lane highway. The state has invested fifty-four million dollars in this project to improve traffic in the area. And what they generally have told us is listen, [1:33:47, 1:33:56]: We understand that y'all have needs for traffic in this particular area. And for us to put fifty-four million dollars there, this is where it all go. [1:33:57, 1:34:17]: We could put it on a two-lane road somewhere else. We could put it um, you know, in a more um you know area that where the infrastructure wasn't there, but when the state steps up and plans to spend fifty-four million dollars uh on a project, and honestly, ideally, if you look at it, if you're a resident living [1:34:17, 1:34:26]: at this particular development, you could basically walk to Walmart because a lot of times these particular projects are approved [1:34:27, 1:34:47]: And Jodeco was kind of proved in the inverse of this, where the rooftops came first. In this situation, the commercial was already built in the Walmart, the Bank of America, you know, you have the Children's Health Care Center already there. So the commercial is already there. So there's no commercial that is actually [1:34:47, 1:35:07]: Included in this. It's all residential. The original zoning was mixed use so that those residents will be able to take advantage of the Walmart or what have you. And what would generally happen is these residents, once the new road is complete, and the new road is supposed to be complete in December of 2026. [1:35:07, 1:35:27]: If you can't see it now from the Hudson Bridge roadside, but there are logging companies out there working right now to remove it. And they removed a bunch like ten tru ten truckloads of log so far in orders for the rud right of way to be moved through there. So these residents, again, once they leave their area, they'll be able to take [1:35:27, 1:35:47]: Take a left, go toward Walmart, go down the hill by Bank of America, go directly to Jodico Road, and continue on to Jonesboro Road without ever getting on I-75. Nobody in here has that type of access currently, but that's what this neighborhood would have. And being [1:35:47, 1:36:07]: Able to access this particular area. But certainly those things are very important in doing what we wanted to do. We had a number of discussions about uh the the amount of brick that would be involved uh in the development. Uh the came forward. There's a lot of push and pull where we talked about. [1:36:07, 1:36:27]: which units will have full side on the brick uh on the units so that that that the the appearance and the value would be upheld and then uh subsequently there was a there was uh a proposal for them to add brick to the side uh of the units uh as well so certainly I just wanted to give [1:36:27, 1:36:47]: Get that out there and let everybody know, honestly, these there's been so many discussions that have gone on along this period of time to make sure that whatever we proposed and whatever was presented was actually something that would be befitting of the community. Because this product that you see. [1:36:47, 1:37:07]: See displayed right here. This wasn't the original product. And I know, and I'm gonna tell you all out there who I it really disappoints me that one of the neighbors put out a rendering of a neighborhood that had no connection with this. It was never good, the picture that you [1:37:06, 1:37:26]: You saw on next door was never even proposed, but it was presented to you as what the neighborhood would look like. We talked and discussed what the neighborhood would look like, and this is what the neighborhood will look like right here with these town homes, with the with the overhangs on them, with porches on them. Um [1:37:26, 1:37:46]: with a nut with uh with the brick and then as miss Gantt says she likes to have that variation so you can have some options of having a craftsman style home so there's some flexibility there uh as well so those are uh what I wanted to do because there's been some public um comments back to [1:37:46, 1:38:03]: to me about what the public wanted to see and it's a conc concern about uh the traffic and the infrastructure over there. But certainly uh the news is good with the state fending fifty four million dollars on a brand new highway uh to go through this area. Thank you. Okay. [1:38:03, 1:38:23]: Mr. Thomas, sir. Yes. Mr. Anderson. Yes, sir. Uh my concern is with setbacks. And I've been wanting to ask this question um before. And then I notice here uh it is a request for the front yard setback. Yes, sir. The backyard setback. No, not the rear yard, just [1:38:23, 1:38:41]: the front yard and the distance in between buildings. Okay. So the they're they're asking for a they were originally asking for a a 30 foot reduction in the front yard setback, but they have agreed to uh a 30 foot front yard setback in the updated site plan. [1:38:41, 1:39:01]: So with with setbacks, I'm looking well, give me your I guess reasoning and future uh reasoning for setbacks when originally we had set it at 50 and it seems that most of these requests are coming in now is to it's to set [1:39:01, 1:39:21]: So just give me uh uh first philosophy. Uh yes, sir. Um behind this. Yes, sir. Um when the when the unified development code was um uh adopted in March of uh twenty twenty two, it had uh a s front yard setback requirement in the MFR district of fifty feet. Uh [1:39:21, 1:39:23]: However, um [1:39:25, 1:39:36]: past few years we have um come to discover that most jurisdictions has have a front yard setback of twenty five feet. Okay. So um we'll be coming forward um to counsel [1:39:36, 1:39:40]: In the next couple of weeks to finalize our new MFR standards. [1:39:40, 1:39:44]: We're we're updating that section in the unified development code and we'll be um [1:39:45, 1:39:58]: stating that the city of Stock we'll recommend that the City of Stockbridge has the thirty foot front yard setback. But uh in a survey of all the surrounding communities and jurisdiction, we found that most places have a twenty five foot front yard setback for town homes. [1:39:58, 1:40:08]: So that's why um in in the past the council has approved um a reduction to thirty feet. So we're trying to be consistent with our recommendation. [1:40:09, 1:40:27]: So once these changes are made with the unified development code, these requests then will not be coming Yeah, it will significantly reduce the amount of requests as it relates to front yard setbacks. We will be uh keeping with the n national standards and uh best practices, best practices as it relates to front yard setbacks. [1:40:28, 1:40:30]: Thank you. All right. [1:40:30, 1:40:50]: Any questions, sir? Uh Ms. Gantt? No question. Okay. You you have something else to do? Yeah, I just wanted to add this. Councilman, I'm fully on board with what you just said, pretty much, and I'm on board with what the staff recommendation is. That's the standard that we have set here in the community. So certainly that's the staff recommendation as well. Yes, sir. That that we [1:40:50, 1:41:10]: go with third because that's what we've been doing. So certainly I think you all have made it clear that that's what we wanted. So that's certainly a there a pri they are are or allowed to ask, but certainly that's what we've um generally settled upon in almost every development that we've approved, right? Thank you for that. Thank you. Ms. Battle, please [1:41:10, 1:41:20]: Please. Join Mr. Anderson and uh I don't know if you I don't know if you have any more of our presentation or something you wanna lay out for the rest of myself and the rest of the council. [1:41:20, 1:41:29]: I'm sorry, I went to the wrong Anyway. I do have a presentation. Okay. And uh let me see if I can get back to mine. There we go. I think we're good. [1:41:40, 1:42:00]: Good evening, Michelle Battle with Battle Law, 3562, Habersham at North Lake, Tupper, Georgia, 30084. Um glad to be here before you all this evening, representing Lenar. I'll try not to be too redundant. Um we are seeking the future land use amendment from medium distantly mixed use. [1:42:00, 1:42:11]: to medium density residential. And the purpose of that is because our project, while a part of a larger mixed-use development, is a single parcel. Oops. [1:42:11, 1:42:31]: Sorry, right there. Let me try that again. Michelle Battle with Battle Law, 3562, Haversham at North Lake Tucker, Georgia. Um, we are seeking a future land use amendment from medium density um mixed use to medium density residential. That is really fueled by the fact that the medium density mixed use designation um [1:42:31, 1:42:51]: Requires a mixture of uses from our perspective. This is a single parcel that we are seeking to develop for residential that's within an area that already has the mixed use component to it. So by making that change, we are allowed to do the development and rezone to MFR. Also the [1:42:51, 1:43:11]: This property is already indicated is in the parkway overlay is within the overlay district and the MFR district is consistent with that overlay as well. The rezoning we are seeking is from general commercial to multifamily, and it's already been discussed about the two variances that we are adding. [1:43:11, 1:43:31]: Asking for. Certainly we feel that the 50-foot, as staff has already indicated, is not standard. Much more typical for a single-family detached home. These units will be closer into the street. However, we'll still maintain sufficient distance to allow for the two cars in the [1:43:31, 1:43:51]: garage as well as two cars in the parking pad in front without any um car or um SUV overhanging into um the right-of-way. And so I think that that's the main thing is that you don't want cars hanging into the right-of-way and we will still be able to achieve that um with the 30-foot um setback [1:43:51, 1:44:11]: versus a 20-foot. And then the variance to reduce the side yard setback from five feet to 10 feet was also proposed. When we look at the site, we are adjacent and kind of smashed between single family detached residentials, some multifamily north of us. [1:44:11, 1:44:31]: And to the, actually that's to the east of us. And north of us is technically the Walmart facility. Along with Taco Bell on one side. We've got a liquor store across the street on the other side. We've got a strip center that is located north of the site. [1:44:31, 1:44:46]: as well. And we can see here on the zoning map where it's currently zone C2, while there is MFR certainly already in the area and immediately adjacent to us on the north side. [1:44:47, 1:45:07]: The property immediately um I I'll say to the left on the site plan, um those properties are actually located in unincorporated uh Henry County. Um so we are really kind of the last parcel on this side um with um being adjacent to unincorporated um Henry County. [1:45:07, 1:45:07]: Mm-hmm. [1:45:08, 1:45:28]: When we look at the site, the subject property is kind of a part of what had been an originally conceived 72.69 acre planned commercial retail residential project, which was being developed by multiple owners. Hudson Bridge Drive is a private street which provides shared access. [1:45:28, 1:45:48]: To over 20 stores, including the following businesses: QT, Walmart, Chipotle, JNJ Liquor, Taco Bell, Zaxby's, Murphy's Gas Station, Mellow Mushroom, Arby's Discount Tire, and Bank of America. In 2004, the 22.076 acres was owned that we're looking at was owned by the Baptist Red. [1:45:48, 1:46:08]: Retirement communities of Georgia and along with the adjacent 9.67 acres that has been developed as a commercial retail plaza. As part of that development, at that time, the Baptist retirement communities had actually agreed to place a restrictive covenant on this property, which prohibited it from [1:46:08, 1:46:28]: From even being developed for any type of retail purposes, despite the fact that it was zoned C2. But the residential apartments were never developed. That particular restriction did go away, but it gives you some sense that this was always intended to be a space for some type of residential development. [1:46:28, 1:46:48]: And that initially it was kind of conceived it would be apartments. And when you look at the overlay district, that allows currently up to 45 units per acre under the overlay district, all the way up to 60, depending upon how many amenities and other things that you use. [1:46:48, 1:47:08]: Nowhere close to that, being at under seven units per acre. We have not even attempted to reach that level of density. I will say that I had another client that had been interested in this property where we commenced with an application. They did want to do a multifamily project. Commissioner [1:47:08, 1:47:23]: uh council member alexander asked them to um s consider adding a fee simple component with some townhomes. Um fortunately they were not able to make that project work and so they elected to withdraw their application and since that time Lenar has picked up the ball. [1:47:23, 1:47:43]: Um with the proposed project. When we first came before you, we were looking at the project at a hundred over 140 units on the site, all townhomes. However, there were single-family, sorry, there were one car garage and two car garage units. We have since, after um meeting with the commissioner, changed to [1:47:43, 1:48:03]: The current updated site plan, which was shown by staff. Um, where we come in off of Hudson Bridge Drive, there will be an amenity area off to the right where we will have uh a swimming pool and clubhouse. Um, also the mail kiosk will be over in that area, and we will also have um some guests. [1:48:03, 1:48:23]: parking within that space. As you come into the community, when you get down a little bit further to the left, you'll be able to make that turn and in kind of a partial cul-de-sac, there will be a playground that will be located there, kind of a pocket park with a few parking spaces as well. [1:48:23, 1:48:43]: in front of that area. And then as you continue around, there's also a secondary pocket park area with some more additional parking that will be open space that will allow for community play and recreation. We do have access onto the adjacent community [1:48:43, 1:49:03]: Community. We're fine with whether that's a full service access or if it were more appropriate to have that as some type of gated access with a Knox box if you didn't want to have direct contact into that adjacent community. We believe, however, that having that point. [1:49:03, 1:49:23]: point of access would allow residents over there to be able to access the Walmart and other spaces without having to come back out onto Hudson Bridge Road and then come back around past um the QT and go through. So it would be a much better access point to allow for that. [1:49:23, 1:49:25]: level of connectivity. [1:49:26, 1:49:46]: Um one of the things that was discussed was um brick, and brick was very important um to Councilmember Alexander. Um we have arrived, we believe, at what we hope is a compromise position um in which we will have five units that will have brick sides for units one, fifty-six, fifty-seven. [1:49:46, 1:50:06]: 189 and 127. Those would basically be those units that are visible from the street, both from Hudson Bridge and then from the side street off into the Oak, I can't want to say Oakville, but I don't think that's what it is, manor subdivision that's adjacent. So we would have [1:50:06, 1:50:26]: Um, all brick on those sides, and the balance of those units would have a brick water table that would be no less than six feet in height, is what we are proposing. The original water table would have been somewhere around two feet. We have increased that um by three times the amount up to six feet so that you have a nice um facade in between. [1:50:26, 1:50:46]: Between the units, but again, those units that face the public right-of-way would be all brick on the side. Again, we are looking at 127 units 24 feet wide. These units will be roughly 800-1,800 um square feet up to [1:50:46, 1:50:57]: to about 2,000 um square feet in size with both uh three and potentially four bedroom units um that will all be for sale units. [1:50:58, 1:51:18]: This gives you an idea of the green space that's on this site. One of the things that you might notice, and I'm going to go back a little bit, is that our site plan has a stream located on the north side of the site. And so you've got a tremendous amount of green space that will be left in place that kind of buffers up. [1:51:18, 1:51:32]: us from the um businesses that are located um adjacent within that um subdivision. I think I have more time because we had three applications that we took at one time. Yes ma'am, thank you. [1:51:35, 1:51:55]: Um these are the facades um that we proposed. Um Lennar came back after comments from Councilmember Alexander and revamped um what was originally proposed. You can see here that we have more gr decorative garages that um will be different colors that kind of blend in with the facades of the homes. Um [1:51:55, 1:52:15]: In terms of the different architectural features, we are allowing for architectural accents, which you see more up around the roof line of the property. Additionally, this doesn't show the brickwater table or up to the six feet on the sides, but that again is something that we are. [1:52:15, 1:52:17]: are um proposing and have agreed to do. [1:52:19, 1:52:22]: I do have a video, so I'm gonna let that play. [1:52:24, 1:52:26]: To give you an idea of the project. [1:52:35, 1:52:55]: And I think you will see as we are moving through, we are holding to the standard with regards to the different looks. We think it's a very clean, upscale look for the area, particularly when we look at some of the other townhome communities that are located, no disrespect, but we think that this will be one of the [1:52:55, 1:53:06]: prime ones in this area, um in the immediately surrounding area of the site and looking at all the things, wonderful things that are happening along uh this side of Stockbridge. [1:53:09, 1:53:18]: This is the area um where we would have the gazebo um not the gazebo, sorry, the clubhouse and the pool areas in the male kiosk. [1:53:20, 1:53:21]: This is the swimming pool area. [1:53:24, 1:53:44]: And all of this open space area will be maintained by the HOA. There will be a mandatory HOA with mandatory homeowner assessment dues. They will be required to pay those dues in connection with the maintenance and upkeep of the surrounding of the area. [1:53:43, 1:54:03]: And one of the things that staff, and we'll go over this, but there was a request with regards to it being a gated community. We are actually opposed to it being a gated community for a couple of reasons. Number one, having a gated community means that all of the streets that are located within this community would have to be private streets. [1:54:03, 1:54:23]: By having them as private streets, that means that these homeowners will be responsible for the maintenance and upkeep of those roadways. And quite honestly, with only 127 units, they already will have three different separate amenity areas, including the pool that they will have to take care of and maintain, along with the clubhouse, along with the playground. [1:54:23, 1:54:43]: Ground area and the other open space, all of that will be wrapped into their annual, potentially monthly dues that they will have to pay on the site, rolling in additional costs for the maintenance and upkeep of those roads, along with the detention ponds, mind you, because they will also have to maintain those. [1:54:43, 1:55:03]: We feel we'll place um when you look at the overall cost for these units, which we believe will be in the high threes to low fours, based on um the amount of brick and other amenities within the community. Um we believe that that's around where the price points um will land. Um and that's assuming [1:55:03, 1:55:23]: In the next two years, it could be much higher than that. We are very concerned about adding too much burden onto this community, and I think it also blocks off the ability of the adjacent community to be able to come through the site and make it over to the Walmart and the other stores without having to come back and add more traffic. [1:55:23, 1:55:30]: Traffic onto um Hudson Bridge Road. So or yeah, Hudson Hudson Bridge. [1:55:30, 1:55:31]: Boulevard. [1:55:31, 1:55:51]: Sorry, Hudson Bridge. I'm just gonna call it Hudson Bridge. One's drive and I think the other's road. So without having those cars having to come back out on the Hudson Bridge, they would be able to make that connection. Um they could walk through the community because there will be sidewalks. So that would allow for walkability as well as reducing cars back out on the main thoroughfare in order to get into [1:55:51, 1:56:11]: To the Walmart and the other uses that are there. We are consistent with the request to have 10-foot sidewalks along Hudson Bridge Road. We did want to note that there is actually a stream, as we indicated previously, on the property, and as a result of that, there is about a 10-foot [1:56:11, 1:56:31]: 10-foot drop at a certain portion of the property into the site, which makes it very difficult to have a 10-foot sidewalk along the entirety. So we're asking to go ahead and place that 10-foot sidewalk up to the spaces where you have the significant drop-off because at that point we would be required to put in significant retaining. [1:56:31, 1:56:36]: walls in order to ensure the safety of folks being able to walk around there. [1:56:36, 1:56:56]: I can tell you that that area that I'm showing here shows that drop off. It's actually roughly more like 20 feet from where the current sidewalk is dropping down. But that's only really kind of at the intersection where you're entering into the adjacent commercial component. So a significant [1:56:56, 1:57:16]: Portion of the frontage along this property will have 10-foot sidewalks as proposed. With regards to the staff's conditions, I just want to run through those. There are a couple that we would ask for modifications. Number one, in section 2A, the to add the last revised date of September 26, 2024. [1:57:16, 1:57:36]: for the site plan, which shows the 24 lots with the two-car garages. Currently the staff recommendation makes reference to the plan from February. So we want to make sure that we are referencing the correct site plan. We would like to delete the gated community requirement. I've already provided my rationale [1:57:36, 1:57:56]: Why we feel like that is more appropriate. Um one staff also in 2D um requested eight foot sidewalks. We are asking for them to be five foot sidewalks. That is what is standard. Um and um the eight-foot is more for a pure mixed-use development. Um we don't believe that that is what we are, and therefore [1:57:56, 1:58:16]: Or under the code, the five-foot requirement should prevail. That also plays into why we asked for 2e, where it says that there will be an eight-foot multi-use path in the interior of the community, that we would remove that, and that the amenities will be a pool, clubhouse, a pocket park with a playground. [1:58:16, 1:58:36]: Ground and one pocket park with just open space. Then there was 3A and B. In 3A and B, there's reference to the one-car garage units and the percentage of the units that can be one-car garage. We would ask for that to be deleted and instead replace that there will be a two-car garage with [1:58:36, 1:58:50]: brick fronts with hardy plank or other fiber cementace accents, a six-foot brick water table on the sides, except that units 1, 56, 57, 89, and 127 shall have a full brick side. [1:58:50, 1:58:53]: And then finally the external sidewalk along the development [1:58:53, 1:58:56]: property line shall be ten feet up to where [1:58:56, 1:58:58]: The topo requires a retaining wall. [1:58:58, 1:59:03]: So um otherwise we are comfortable with the recommendations made by staff. [1:59:03, 1:59:23]: And we appreciate all the work and effort. Um, Councilmember Alexander and I have been around and around. He probably got real tired of me and a little testy with me the other day because I was being uh a zealous advocate for my client, but I also understand what his objective is um in terms of bringing quality development um into the city of Stockbury. [1:59:23, 1:59:38]: Bridge and certainly within his district. And so I have great great respect for that. And uh as we continue to try and do our job out here, um, we try to do our best to um meet you where you are, um, even though sometimes I can't give it all, but I hope that this is close enough. So thank you. [1:59:38, 1:59:52]: Thank you for your presentation. Um I would imagine please don't go anywhere'cause we have some pretty sure we have some questions. So Mr. Alexander, you wanna continue on, sir? You kept some thoughts? Yeah, let me just say this. Uh I appreciate it. We've been battling it out. [1:59:52, 2:00:12]: Miss Battle. Absolutely. We've been doing that. And trying to figure out how this was gonna work, uh, in terms of getting what the city wanted and getting what we wanted, what you want or your client wanted. Certainly affordability did come into the equation in terms of what we wanted in in the final product uh of the [2:00:12, 2:00:32]: this particular development. Um I certainly uh in terms of uh these initial requests certainly we had many discussions about the community being gated and certainly that was something that I was desirous of and the community was desirous of uh and just uh with some of the comments that had come [2:00:32, 2:00:52]: Forward. Um in terms of the sidewalk itself, again, 10 foot along the frontage up until the stream being required. Certainly, uh staff has recommended made some good recommendations here, and certainly we're trying to go along that destination of having uh multiple. [2:00:52, 2:01:12]: to use paths as far as possible and with the exception of now that you're asking for the stream uh situation then um you know the the path is is appropriate because you're getting a reduction in how much 10 foot path that you have to do. Certainly with [2:01:12, 2:01:32]: We went round and round on three A and three B, and I think this is the appropriate solution in that these units one fifty six, fifty-seven, eighty-nine, and one twenty-seven will have a hundred percent brick uh on the side, and then there will be a water table that was initially a small water table. I think we had to see. [2:01:32, 2:01:52]: having she said six foot here, I think we had discussed having about half of it be um be uh uh uh uh we you say six foot here, I think we had discussed half of it being um the water table extending up to half. So whatever that six feet is between where we were in [2:01:52, 2:02:12]: uh with this right here. But certainly you said around six feet. So certainly we'll be able to, staff will be able to work through this and come to a resolution with uh with uh with uh with what is appropriate uh on the building ab uh six around six feet and above. So we'll go there. [2:02:12, 2:02:32]: I I I approve of the development because I think that it will be beneficial to the entire area and I think it raises the quality of the area. And what is the price point again for these particular units? They'll be in the high threes and low fours. Okay, three fifth three. [2:02:32, 2:02:37]: fifty uh in in in around the area. And the square footage was eighteen hundred to [2:02:38, 2:02:39]: A little over two thousand. [2:02:39, 2:02:59]: Right. And so that's a qu when my desire always in these projects has been to have a single family, a both of these are single family, which is a town home and detach, is that when you walk inside these units, you will not be able to tell the difference between it and a single family detached home. [2:02:59, 2:03:19]: Because it at 1,800 to 2,000 square feet, they're larger than a lot of single family homes, which are 1,500 to 18 to 1,800. So the difference here being is that you will have uh again a very nice drawn-out development in terms of uh what what all is [2:03:19, 2:03:33]: presented and then the package put together will be a very desired neighborhood with which to call home. Those are my comments. Okay. Council, any other questions that you may have for uh Miss Battle at all? [2:03:35, 2:03:41]: Okay. And what do I understand from you then Mr. Alexander, these staff conditions seem to be a all right with you at this point? [2:03:41, 2:04:01]: The staff conditions are pretty much uh what we wanted to go with here in terms of and then as again we had actually discussed okay amongst ourselves having the community be gated. All right. Oh I understand so uh public hearing. So anybody on my far left with comments uh that they don't like particular [2:04:01, 2:04:09]: staff conditions or this this community be built. Uh disagree with anything that's happening. On the on far left, in the middle. [2:04:10, 2:04:17]: A far right. These are com okay, ma'am, these are comments uh that are not in agreement with this. Okay. Give your name and address, please. [2:04:17, 2:04:37]: Um good evening. My name is uh Jocelyn Williams, 190 Banks Drive, Stockbridge, Georgia, 30281. For the last hour I've been uh amazed and so grateful for um this wonderful presentation by Miss Battle. Um I'm in complete opposition to it because I live in the area and there are [2:04:37, 2:04:57]: Over 100 businesses in the last three traffic lights that I go to this weekend. When I went to this weekend starting at Wendy's, I mean uh at Ms. uh Popeye's turning left going down uh Hudson Bridge Road and trying to go into QT, Bank of America, took me about [2:04:57, 2:05:17]: Fifteen minutes. I know we have to build. I know things will come. I'm just standing in opposition with five thousand other people that can't come. Uh I know you're gonna vote tonight, but I just wanted to let you know that I'm in opposition. The infrastructure is tiny as we keep building beautiful things around, but there's just not any room. [2:05:17, 2:05:30]: So I'm asking the council if you can just to hear the voices of the people in the community if you can. And thank you for your counsel. Once again, the beautiful presentation to Miss Bowell. Excellent presentation. Thank you. [2:05:30, 2:05:38]: Thank you. Okay, if there are no other comments uh uh against this or negative and aspect any comments for from my far left. Comments for this development. [2:05:38, 2:05:40]: In a million comments four. [2:05:41, 2:05:43]: Okay, my far right. Any comments four? [2:05:43, 2:05:46]: Okay, so on that note that I'll close out that portion. [2:05:47, 2:05:52]: Um Miss Battle and Ryan, b back up for a second. Traffic issues and concerns. How can you address that? [2:05:54, 2:06:04]: Traffic conditions. Yeah, just out of curiosity, traffic issues and concerns it concern that was mentioned here. Yeah, Miss uh the the applicant addressed uh most of the con traffic concerns about um [2:06:05, 2:06:08]: Uh changing their entryway to to being off of Hudson Bridge Road. [2:06:08, 2:06:23]: Okay. So that address most of the c concerns and also if we eliminate the um the gate, it would keep people from queuing in the streets and uh causing a backup. Um so we think that would be another remedy to uh alleviate the traffic concerns. [2:06:24, 2:06:43]: Okay. And I also um we need to um get the uh specific conditions down so when we make the uh motion we'll have it in the record. Okay. So there's some standard things that um that the um department requires along with um [2:06:44, 2:06:46]: Like flock cameras and um [2:06:48, 2:06:55]: the certain type of lights, street lights, black lights and things of that nature. So we want to make sure that we capture all that in the um [2:06:55, 2:06:56]: And the final version of [2:06:57, 2:07:00]: the conditions that will be associated with this. [2:07:00, 2:07:20]: Well, as I read through each one, it's four four we have to take four votes tonight. So as I read through go through each of that, all right, we'll see what the conditions are just uh associated with the rezoning. Everything else is just straight up approval. Recommended approval. Okay, rezoning okay, so that okay. Well the rezoning piece you're referring to, that's the second that'd be second vote then. Yes, sir. Right. All right. [2:07:20, 2:07:40]: Yes, sir. Let me say this again. As the the presentation and the discussion, I it may it merits sense that we might not want to gate the community because of the connectivity uh and the walkability uh through the community. Uh and um again [2:07:40, 2:08:00]: And having the gate open and close might actually impact the traffic in the area. So I think that would be a a general compound, but we're gonna insist, since it's gonna be walkable, that we do have the the trail that runs through the community. Uh the staff had recommended that that that we [2:08:00, 2:08:02]: We have a multi use trail through the community. [2:08:04, 2:08:24]: Let me double check double check. There was a comment that there was to be a walking trail. I don't know if that was supposed to be along the um the creek, although I would not be putting folks back there behind. Right, but if people are accessing and walking through the community, it would be good for them to be able to ride their bike through the community. [2:08:24, 2:08:44]: And for the residents to be able to ride their bike, they can't do that on a five-foot sidewalk. Go back to put the conditions back up there. They were already up there. Okay. I'd like to point out on the site plan itself that one of the challenges that we have is that we can't push back out the street widths that we [2:08:44, 2:09:04]: Are required to have if we're gonna put in eight foot sidewalks, we're gonna have to be able to push these units um back along with the fact that we are we had asked for the 20-foot setback, now we're at 30 feet. Well, what I'm saying is that we only need it on one side, we won't need it on both sides. Okay, just like through that main spine road there that's coming from the oak. [2:09:03, 2:09:16]: wood subdivision up until the uh the main entrance it would be one side would be eight foot and the other side would be the stri strategic five foot. So one side would be eight foot and the s other side would be five foot. Right. Okay. [2:09:17, 2:09:17]: All right. [2:09:19, 2:09:20]: Right. [2:09:24, 2:09:31]: So it seems like, um, just pointing out it would seem to me that would make sense if we did the sidewalk on this side. [2:09:32, 2:09:33]: Okay. [2:09:33, 2:09:40]: Okay, the only other thing that I think I have mentioned to you is that uh uh you s put the rendering back up there again. Okay. [2:09:42, 2:09:58]: is that those overhangs which are over the garage, instead of being the traditional uh shingles, that those would be metal roof versus having uh a shingled roof right there for the attractiveness and just the overall look. [2:10:02, 2:10:11]: What can I say right now? Um, you know, we went back and forth about that, but um I'm I don't have anybody here to say yes or no, so I guess I'll just acquiesce. [2:10:12, 2:10:16]: Thank you, I appreciate that. So yes, you're agreeing to that, is that what you're saying? [2:10:16, 2:10:18]: I don't think he's giving me much choice. [2:10:19, 2:10:20]: So thank you. [2:10:20, 2:10:27]: It it'll look very sharp there and it'll be something that we we actually that's gonna be one of the changes that we're making, right, Mr. Anderson? [2:10:28, 2:10:48]: Right. And one of the I mean the text amendment that we're working on. And the brick on the ends. Brick on the end. Right. We got that, we got the items that are in there. Put the conditions back up there. Number one, we got the buildings that are gonna have full brick on the side. And that would be building number 156, 57, 89, 127, what? [2:10:48, 2:11:08]: Have a hundred percent brick on the side. The rest of them will have the water table, which is a six foot uh water table on the side of brick going up to six foot high on the side. But these main buildings that will be visible from both entrances will have a hundred percent brick uh on the side. And again, we reduce the units right now that. [2:11:08, 2:11:17]: That um the um the density number will go down that you went from one forty down to one twenty seven. That original density number was basically What it was over seven. [2:11:18, 2:11:24]: Right, it was six point eight seven, but now with a hundred and twenty seven that'll go down. Yeah, and we'll condition on the site plan. [2:11:24, 2:11:38]: Absolutely. Okay, well that th I think we're that's that's what's agreeable. Uh and it seems to me two D then should change the eight foot sidewalk requirement to five foot on one side and eight foot on the other. [2:11:39, 2:11:54]: So we've had And then it will be ten foot along the frontage up to the screen. Correct. And I I put that in number four. And and I followed the um actual conditions, so two A, B, D. So that way you can follow it. [2:11:54, 2:11:58]: You got these jotted down, sir, so we can read'em. Okay. [2:11:58, 2:12:18]: So I'm gonna go through this process and those are those adjustments that have to be made after I read this process here to make sure we're added in properly. All right, so let's start this. Once again, comprehensive plan amendment, KCP-2024-01, Council District 5. Consideration of comprehensive plan amendment request to change the future land use. [2:12:18, 2:12:38]: Designation on the property on north side of Hudson Bridge Drive, comprising parcel 032-0102-6000 from a medium density mixed use to a medium density residential to allow for construction of townhome development. Applicant Leonard, Georgia LLC, Agent Battle Law. [2:12:38, 2:12:50]: L PC property is located on land lot twenty-one of the district six and it contains twenty point three seven three six seven acres. Okay. Now is there a motion to accept this as well? [2:12:51, 2:12:53]: So move. Is there a second? [2:12:53, 2:12:56]: I second. Mr Mr. Berry, I second that. [2:12:57, 2:12:59]: All on favor, please indicate. [2:13:00, 2:13:01]: Nice decision on that note. [2:13:02, 2:13:02]: Okay. [2:13:03, 2:13:23]: That's that passes. Rezoning case RZ-2024-01. Council District 5. Consideration and request to rezone property on the north side of Hudson Bridge Drive comprising a parcel that's 032-01-02600 from the C2 General Commercial Zoning District of N. [2:13:23, 2:13:43]: MFR multifamily, excuse me, multifamily residential zoning to zoning district to allow for the construction of a townhome development. The property also lies within a PMU Parkway Mixed Use Overlay District, Applicant Lenaire, Lenar, Georgia, LLC, Agent, Paddle Law, PC. The property is located on landlock 21. [2:13:42, 2:13:54]: district six and contains twenty point three six seven acres. Once again I need a motion to accept this proposal. Okay. Would you read the conditions, Mr Anderson? [2:14:08, 2:14:19]: Make sure we can hear you, Mr. Anderson. Uh uh first condition will be a revised uh the the result of the the cycle that does the results be [2:14:20, 2:14:30]: Condition of a revised site plan of September twenty-sixth, twenty twenty four for the site plan showing all twenty-four foot lots with two car garages. [2:14:30, 2:14:31]: Um [2:14:33, 2:14:53]: There will be an eight-foot sidewalk with a barn on one side and a five-foot sidewalk on the other side. Um external sidewalk along the development property line should be 10-foot up to where the topo requires a retained wall. There'll be a level roof overhang over the garage, of course, block cameras at the entry. [2:14:53, 2:14:57]: It's uh black bowl lights. [2:15:00, 2:15:00]: Yeah. [2:15:05, 2:15:17]: Front elevation shall be brick. Um facing the public right of way buildings 156 156 5789 and 127 shall be all brick on the side. [2:15:18, 2:15:19]: Okay. [2:15:20, 2:15:20]: Your own. [2:15:24, 2:15:29]: Water table. The water table up to six foot on the rest of the buildings, yeah. [2:15:31, 2:15:44]: It's in the it's it's written down there. Brick water six foot brick water table on the sides except one fifty six, fifty seven, eighty nine, one twenty seven shall have full brick sides on them. So move. [2:15:44, 2:15:47]: Is there a second? I'm sorry. [2:15:47, 2:15:50]: Yeah, flock camera. So the mandatory HOA is that part of [2:15:51, 2:15:57]: It's in the code. Okay. Reduced to a hundred and twenty seven units. I didn't hear him say that. [2:16:00, 2:16:00]: Thank you. [2:16:01, 2:16:07]: And the thirty foot setback. I didn't hear that. [2:16:07, 2:16:11]: That's coming next. Oh I'm sorry, that's on the big That's next, yes, that's next. [2:16:11, 2:16:14]: And that they were going to be all four sale units. [2:16:16, 2:16:22]: That's in the code, right? Owner occupied. That's in the code. Owner occupied is in the code now, right? [2:16:24, 2:16:28]: Right. Is there a ten percent rental cap an easy? It's in the coding. [2:16:29, 2:16:30]: I'm just stuck anywhere. [2:16:31, 2:16:34]: All right, so m motion was made, you got the corrections on that. [2:16:35, 2:16:40]: Yes, sir. Did you say the metal roof? Uh metal roof overhang over the ports and garage. [2:16:44, 2:16:44]: Block himself. [2:16:45, 2:16:46]: Yeah, flying. [2:16:48, 2:16:49]: Light pose. [2:16:49, 2:16:51]: All right, thank you. [2:16:53, 2:17:10]: Okay, Ms. As I made a motion, so move that. That was Ms. Gantt, you second that? I do. Ms. Gantt second that. If there's no further discussion, all in favor please indicate. Okay. It passes unanimously on that note. Okay, now for the variance case R V two Zero Two Four Zero Three, Variance Request Number One. [2:17:11, 2:17:18]: Council District five consideration of variance request for two variables on a property on the north side of Hudson Bridge Drive comprising a parcel number [2:17:19, 2:17:39]: zero three two dash zero one zero two six zero zero zero to allow for construction of the town home development variance number request number one will reduce the front yard setbacks of the town home lots from required fifty feet to twenty feet. The property also lies within a PMU parkway mixed use overlay district applicant liner uh [2:17:39, 2:17:49]: Georgia LLC, Agent Battle Law, PC with the property is located in landlock twenty one of District Six and contains twenty point three six seven acres. Sir motion to accept this, please. [2:17:52, 2:18:10]: That the the we wanted the setback to be thirty feet on the front. I'm reading it. That's fine. You can make a motion to adjust that. Your motion would be to adjust whatever you need. Right, thirty feet uh on the front setback and the staff recommendation uh on the side setbacks. [2:18:10, 2:18:12]: Okay. Is there a second that motion? [2:18:12, 2:18:13]: I second. [2:18:13, 2:18:33]: All right, our favorite please indicate. Okay, so you now have to say on that. Okay. All right, next uh variance case of RV two zero two three, excuse me, two zero two four-zero three. Variance request number two, council district five. Consideration of variance requests for two variances on a property on the north side of Hudson Bridge Drive, comprised on parcel zero. [2:18:33, 2:18:53]: That's zero one zero two six zero zero zero to allow for the construction of townhome development.
