--- title: Community Zoning Information Meeting date: 2024-12-04 source: 2024-12-04_Community_Zoning_Information_Meeting.wav --- [0:01:33, 0:01:43]: Good evening everyone. Welcome to the City of Stockbridge Community Zoning and Information Meeting. Tonight we have staff. [0:01:44, 0:01:49]: Our director is Ryan Anderson. He's the director over community development. [0:01:50, 0:01:55]: My name is Kedro Jackson. I'm the chief planner in the planning and zoning division. [0:01:55, 0:02:01]: We have Miss Linda Logan, who is the senior planner and the secretary to the planning commission. [0:02:01, 0:02:06]: As well as Gordon Linton, senior planner in planning and zoning. [0:02:07, 0:02:11]: Tonight we would like to go over rules and procedures for the meeting. [0:02:12, 0:02:32]: Um while the applicant is presenting, we ask that those of you in the audience to hold all comments or questions to the end of the presentation and then you will have a 101 session or session with the applicant to ask of any questions you may have. We ask that any comment [0:02:32, 0:02:45]: Will remain to yourself without blurting those out. If you have direct questions or need additional information, you may see a staff member such as Linda, Gordon, or myself. [0:02:46, 0:02:57]: So tonight we will have two cases before you. We have a rezoning case, case number RZ two zero two four-one one. [0:02:58, 0:03:01]: This is located in Council District Two. [0:03:01, 0:03:13]: The city of Stockbridge will hold three meetings in regards to this case. One will be the CZIM, which we are here tonight. The next meeting will be January 13th. [0:03:19, 0:03:28]: Another case we will hear tonight is the text amendment TS 2024-09. This is a citywide text amendment. [0:03:29, 0:03:30]: Um regarding [0:03:31, 0:03:37]: bed and breakfast. Um the staff is making some amendments to this ordinance. [0:03:37, 0:03:43]: And this ordinance will have supplemental regulations in regards to bed and breakfast. [0:03:43, 0:04:00]: So before we begin, we would like to go over the zoning process to explain how we get to this point. It first starts with an initial contact from the applicant. The applicant contacts staff for a pre-application meeting. [0:04:01, 0:04:10]: Um we go over the intention of the project as well as site plan, comments, code requirements, et cetera. [0:04:11, 0:04:17]: After the applicant submits the application, it is now moved to prepare. [0:04:17, 0:04:22]: the application for a board hearing and that preparation includes [0:04:23, 0:04:35]: Legal ads is including um additional information such as uh a water letter from Henry County Water Authority, also um deeds to the property, et cetera. [0:04:37, 0:04:46]: After that information is obtained, the application is now deemed complete and we begin the application for um [0:04:46, 0:04:55]: Research and that research can be site visits, having one-on-one meetings with the applicant to obtain additional information. [0:04:55, 0:04:56]: Et cetera. [0:04:57, 0:04:58]: The application is then [0:04:59, 0:05:10]: put on the agenda for the next planning commission meeting as well as city council and then before it goes to those two boards it comes here. [0:05:11, 0:05:28]: At this meeting, which is again the community zoning information meeting, the public has the right to ask of any questions to the applicant or staff. They may review site plans or any other pertinent documentation regarding the case. [0:05:28, 0:05:35]: So then after city council it is either voted as approved or denied. [0:05:35, 0:05:51]: um whichever decision the city council comes up with, the applicant is then sent a decision letter from staff and that's that's the end of the application process. [0:05:51, 0:05:55]: So tonight, as I read into record, we will hear um [0:05:56, 0:06:01]: A rezoning case RZ twenty twenty four regarding a PUD. [0:06:02, 0:06:03]: Plant unit development. [0:06:03, 0:06:05]: Master plan development. [0:06:05, 0:06:11]: So the applicant is r zoning from PUD to PUD to create a master plan development. [0:06:11, 0:06:17]: The intent is to adopt a master plan for the property to allow for the construction of a townhome development. [0:06:17, 0:06:37]: The applicant is Vista Residential Partners. The agent is Dennis J. Webb Jr. Esquire. The three parcels that are located, they're located in land lot 38 of District 12 as identified. And there are three parcels containing [0:06:37, 0:06:45]: 18.31 acres, and the parcels are zero three zero dash zero one zero zero. [0:06:46, 0:06:51]: two zero zero zero and that is also known as four fifteen flippin road. [0:06:52, 0:06:55]: Which contains thirteen point four three six acres. [0:06:56, 0:06:58]: And then there's parcel number [0:06:58, 0:07:18]: Zero three zero zero one zero zero two zero zero one which contains point eight eight six acres and the last parcel is zero three zero dash zero one zero zero two zero zero two which contains three point nine eight eight acres. [0:07:18, 0:07:21]: At this point I'll go ahead and [0:07:22, 0:07:31]: Allow the applicant to introduce or present his case before you and we'll open the floor to questions. [0:07:54, 0:08:03]: Okay. Oh thank you. Good evening. Uh my name's Alex Brock with Smith Gambrel Russell. I'm here on behalf of uh Din Webb, uh who is also with Smith Gambrel. [0:08:04, 0:08:06]: And uh I am [0:08:14, 0:08:19]: One moment. I'm trying to uh see if I can expand this, but it's not working. [0:08:32, 0:08:34]: Do you know how to get it to like just the page view? [0:08:36, 0:08:38]: Oh, slide joke, there you go. [0:08:44, 0:08:46]: There we go. Thank you. I appreciate that. [0:08:47, 0:09:07]: All right, uh to start over for those in the audience. My name's Alex Brock with Smith Cambrell Russell here on behalf of Din Webb. Um who's with Smith Cambrell and could not be here tonight. Uh we are the representatives of uh for Vista Residential Group, who's the applicant for this application. And uh as uh Kidra noted earlier, this is a rezoning from [0:09:07, 0:09:13]: PUD to PUD to attach a regulating plan or a master site plan to the development. [0:09:13, 0:09:14]: And [0:09:15, 0:09:32]: Before I get into the specifics of what we're proposing for the development, just want to go over kind of briefly what our application is, because it's not your typical rezoning. Uh what we are asking for is uh a rezoning to the same district just for the sole purpose of attaching the regulating plan. [0:09:35, 0:09:47]: This site is located on the east side of Flippin' Road, uh here at the Reeves Creek Trailhead. You can see the Reeves Creek uh trailhead bifurcates the uh the property to the north and the south. [0:09:48, 0:10:08]: Uh this property was rezoned in Henry County in 2019 to mixed use. Uh it was part of a master plan development. Uh at that time it was a let me flip over to it, a larger 100-acre plus master plan of multiple uh uh properties. You can see here our parcels are out. [0:10:08, 0:10:28]: outlined in red. That is what the subject of the discussion is tonight and of the application. This property, when it was rezoned in 2019, subsequent to that, it was annexed into the city of Stockbridge. When it was brought into the city of Stockbridge, the city adopted a zoning of PUD Plan Unit Development, which was [0:10:28, 0:10:48]: was the closest uh matching um zoning district to the Henry County's underlying uh or uh previous MU district. However, when that was brought in, uh a uh attached regulating plan or master site plan was not also adopted at that time. The PUD district [0:10:48, 0:10:54]: requires a the adoption of a master plan uh to regulate the development of the parcels. [0:10:55, 0:11:06]: uh under that zoning district. And since this does not have a attached master plan, uh what we are simply seeking is to uh attach the master plan. [0:11:07, 0:11:27]: And what we s what you see before you tonight is our proposal for 94 townhomes. Uh in 2019, when that overall plan was approved, uh there were uh consideration for 100 townhome units that were approved by Henry County at that time. Uh we have reduced the number of units uh and reconfigured the the [0:11:27, 0:11:33]: layout of the units uh a little bit more efficiently along the property. [0:11:34, 0:11:51]: Uh we are providing uh into basically three sections, one on or one on either side of Fairhaven Road, uh and then another one to the south here, uh south of the Reeves Creek uh trailhead property uh owned by the city of Stockbridge. [0:11:52, 0:12:02]: The developer Vista Residential was also the same applicant for the development to the west of Flippin' Road. However, that is a separate and distinct development from uh these parcels here. [0:12:03, 0:12:08]: Uh what we are only concerned with are the nine to four units that we're proposing on this plan. [0:12:08, 0:12:28]: We are proposing uh sidewalk connections along uh Flippin' Road to the Reeves Creek Trailhead to provide access for the residents to the trail, uh, to use that as an amenity. We believe that's a a strong feature of the area uh in in welcome by the residents and will be well used by the the future residents. [0:12:28, 0:12:30]: Yeah. [0:12:31, 0:12:50]: We are also proposing stormwater ponds uh at each of the uh the pods. We are uh uh considering uh the inclusion of dog parks uh or other green areas uh in turning the the stormwater pond ponds into uh uh from surface ponds to underground detention. [0:12:51, 0:13:01]: Each unit, uh let me flip over to this is a conceptual elevation. Each unit will have two car garages. Uh they will be two stories. Uh [0:13:01, 0:13:03]: Approximately three bedrooms. Um [0:13:04, 0:13:15]: The elevations that you see here are uh conceptual in nature. It's to give a feel for the overall uh architectural uh intent of the [0:13:16, 0:13:32]: of the townhomes. The facade materials will comply with the city's uh requirements. However, the facades that you see on these elevations aren't necessarily the final facades. Those the materials may be adjusted uh as we get further along in the architectural design. [0:13:33, 0:13:50]: So again, just to reiterate, what we are asking for is not a uh rezoning to a new district or to a or to allow a new use. What we are uh asking for is the adoption of a master plan or uh regulating plan for the PUD zoning. [0:13:50, 0:13:54]: Similar to what was approved by Henry County in twenty nineteen. [0:13:55, 0:13:56]: So with that [0:13:56, 0:14:01]: uh I'll end my presentation and and open it up for any questions from the audience. [0:14:07, 0:14:11]: And if there are none, I'll turn it back over to [0:14:12, 0:14:13]: To planning staff. [0:14:20, 0:14:20]: Thank you. [0:14:31, 0:14:44]: Um, since we do not have any questions after this meeting, as stated before, this case will travel to the planning commission. That meeting will be held on December nineteenth, twenty twenty four. [0:14:44, 0:14:49]: In the city council chambers where we're meeting tonight at six thirty pm. [0:14:50, 0:14:54]: That board will make a recommendation of approval denial. [0:14:54, 0:15:14]: Um and then it will move to City Council. City Council will have the final vote on whether this case is approved or not. And that meeting will take place on January 13th, 2025, at 6 PM, also here in the City Council chambers. [0:15:14, 0:15:34]: We have of course the information to this case in our office. So feel free if you're watching to contact staff regarding any questions or if you would like to see the site plan for this case. And I have no further updates. [0:15:34, 0:15:48]: You can open the floor. Okay. There are no other updates. So on your screen are the dates I just previously stated. As you can see here, the Planning Commission and Mayor City Council and [0:15:49, 0:16:09]: Um there are some upcoming projects that we are working on. We are still in the process of making updates and amendments to our UDC, our Unified Development Code. And so look forward to those. And we hope to see you in the new year. So we thank you for working. [0:16:09, 0:16:11]: watching and joining us. Good night. [0:16:39, 0:16:59]: So, although this meeting is not quite over, we do have a test amendment that will be joining the previous case presented to you on December 19th. It is a test amendment regarding our our bed and breakfast. Um, this test amendment will involve some changes we're making um regarding that. [0:16:58, 0:17:10]: Existing ordinance. Right now, the ordinance does allow for bed and breakfast in the RR district by way of a special use permit. [0:17:11, 0:17:12]: That [0:17:12, 0:17:20]: Regulation will remain. However, there are some additional language that we are adding to that ordinance that includes um [0:17:21, 0:17:35]: Um it relates to properties that are existing um today in the city. Um we want to put a grandfather language in there that will allow um one to exist. However, there are some [0:17:35, 0:17:36]: Um [0:17:37, 0:17:49]: Nonconforming regulations that one will still have to follow in regards to non-con legal nonconforming uses. Um also additional information we're adding are [0:17:49, 0:18:09]: um gatherings on the property as well as um the type of uh development um for new bed and breakfasts. So it's not a huge change, just some to bring the code up to date to allow um mainly for those that are currently as [0:18:09, 0:18:29]: Existing as bed and breakfast. Of course, we will release the test amendment to the public on the 12th. So you will have the opportunity to review that test amendment. If one is watching and you have further questions, yes, please call staff and you can call me directly and I can provide you with [0:18:29, 0:18:33]: [1114.1, 1134.1]: And from there, um, as I stated, we are as a staff working on amendments to the code and we're also looking at bringing in new um ordinances or uh regulations to the code. Um we have many great developments that are taking place in the [0:18:54, 0:19:01]: city of Stockbridge. So we are looking forward to becoming a um diverse and well [0:19:02, 0:19:11]: um developed city. So we thank all of our residents, we thank all of our developers, and from that information we conclude the meeting. [0:19:12, 0:19:13]: Again, thank you.
