[0:31:59, 0:32:18]: Comprehensive plan amendment case CP two zero two four dash one one and rezoning case RZ two zero two four dash uh twelve. Um additional information uh has to come forward on that's my understanding, so it won't be heard tonight. I'm not sure exactly when do we plan to Mr. Gardner or [0:32:18, 0:32:20]: Ryan, do you have an idea when we plan to bring us back? [0:32:21, 0:32:28]: February? Sometime next month. [0:33:01, 0:33:05]: On that thank you, Ryan. Mr. Anson, appreciate it. On that uh roll call please, Madam Clerk. [0:33:06, 0:33:09]: Good evening, everyone. Evening. Mayor Ford. Present. [0:33:11, 0:33:12]: Mayor Pro Tem Berry. [0:33:15, 0:33:25]: Mayor Pro Timberry is not in attendance. Councilmember Alexander. Present. Councilmember Barber. Present. Councilmember Gantt. Present. Councilmember Thomas. Present. [0:33:26, 0:33:29]: Mayor Ford, you have a call. Thank you, Madam Clerk. I appreciate it. [0:33:30, 0:33:50]: Council, um there was a m email message from our attorney in reference to making a request to have our executive session earlier in tonight's agenda to cover a particular issue. So I if that's the case, I'd like to uh ask for a um amendment to to agenda to or excuse me a change of the agenda per se. [0:33:50, 0:33:56]: to have that executive session, if you foresee it, after our consent agenda this evening. [0:33:57, 0:33:58]: Is there a motion to do that, please? [0:33:59, 0:34:00]: Mayor Ford. Yes, Mayor. [0:34:01, 0:34:07]: Um so moved to um have the executive session for [0:34:08, 0:34:21]: Legal personnel and real estate matter. Legal personnel I'm sorry. For um litigation, personnel and real estate matters right after the consent agenda. Consent consent on the agenda. [0:34:21, 0:34:41]: Is there a second that motion? Okay, Mr. Uh Alexander second. All in favor, please indicate? Okay, unanimous decision. Now, Council, I need a motion to accept the rest of the agenda as is, please. So moved. Is there a second? Second. Mr. Tom Mr. Alexander, second that from Ms. Canton, Mr. Alexander. All in favor, please indicate. Thank you very much. Okay. All right. Um [0:34:41, 0:34:56]: So what we have is adoption of the minutes, adoption of December 9th, the 2024 council meeting minutes and December 17 December 17th Council Works session minutes. If there are no changes or additions to that minutes, I need a motion to accept those into the record, please. [0:34:57, 0:35:01]: Mayor Poert. Yes, ma'am. The uh January eighth retreat minutes were also asked. [0:35:02, 0:35:03]: I'm sorry. [0:35:03, 0:35:10]: Yeah. And also I'm sorry, there you go. Uh January eighth uh the [0:35:10, 0:35:28]: actual retreat minutes and everybody should have a copy of that as well to be added for the for approval process. So move okay uh uh uh a repro approve of those minutes in regards to the people who were not here for the retreat, certainly I'm sure they may abstain. [0:35:30, 0:35:35]: Okay. Wow. Okay. Uh on that note, is there a second to the motion? [0:35:36, 0:35:39]: A second. Okay, Mr. Thomas second that all in favor, please indicate. [0:35:40, 0:35:42]: I abstain. Okay. I wasn't present. [0:35:42, 0:35:48]: All right, uh so now that's that's to pro some uh propose a little bit of problem because if we have [0:35:49, 0:36:07]: two abstentions and two yays and I can't vote for that so so we're probably gonna have to take the um the ret the at least the uh January eighth retreat maybe off the motion and read and do this with the other two and maybe have the the retreat at a different time or make sure that uh it's confirmed. [0:36:07, 0:36:17]: Okay, re uh rescind the motion uh to approve the admission the mo the minutes mentioned excluding the January eighth minutes for approval. [0:36:19, 0:36:23]: Okay, is there a second to that motion? I second. Ms. Gantt, Ms. Gantt, you second all favor, please indicate. [0:36:24, 0:36:26]: Okay, so now it's a decision on that point. Thank you very much. [0:36:27, 0:36:47]: Uh, Madam Clerk, do we have any public comments at all? There are no public comments, Mayor. Okay, thank you. As typically for our uh our regular council meetings, we have, of course, a ceremonial piece. And uh obviously being the first meeting of the year, we have several different ceremonial swearing ins and ceremonial issues. Uh we also did a proclam, we did a proclamation, of course. [0:36:47, 0:36:57]: for Martin Luther King Jr. Day and uh great always to do that to a great uh photograph with everybody was here in reference to that. Of course Starbury's the ancestral home of the King family. [0:36:58, 0:37:18]: As we did that, we did swearing in of board members, board of committee members, and Stockbridge Citizens Police Advisory Council. Mr. Nathan, Nathan Banks was sworn in, zone two representative. The Planning Commission, Zone Planning Commission there, in the sense of uh swearing in. Stanley Dumas, District One, Jaden Williams, District Two, and Tamika Walker. [0:37:17, 0:37:20]: District 5 was sworn in. [0:37:20, 0:37:40]: Stockbridge Youth Council Advisory Committee sworn in. Jet Clint, Miss Carter. I'm gonna mess up her first name, right? Ms. Carter. Tariqa Goynes, uh Caitlyn Nash, Valerie Simpson Reese, and Dr. Thomas Smith were all sworn in. And then the Henry County Transportation Advisory Representative for Stockbridge. [0:37:40, 0:37:55]: Bridge um Inel Gonzalez was also sworn in during that uh uh ceremonial peace. All right, and so what we have next would be uh the consent agenda and um [0:37:55, 0:38:15]: On the consent agenda, we have a consideration to uh appoint Alicia Gambles to the Stockbridge Youth Council Advisory Committee for a two-year term, which will expire on twelve uh December thirty-first of twenty twenty-six. Also, council consideration to appoint uh Georgia McGuire, McIntyre, I'm sorry, to Stabridge [0:38:15, 0:38:35]: Youth Council Advisory Committee for a two-year term once again December 31st, 2026, and council consideration to appoint Candace L. Jones to the Stockbridge Youth Council Advisory Committee meeting to fill an unexpired term through December 31st, 2025. That's on the consent of gentlemen. Do I have a motion to assess? [0:38:35, 0:38:38]: Accept that please. So moved. Is there a second? [0:38:39, 0:38:48]: Okay, from Miss Gantt to Mr. Thomas. All fair, please indicate. Okay. On that note now I need a motion to go into executive session, please. [0:38:49, 0:38:51]: I already made the motion. We approved that one, Mayor. [0:38:52, 0:39:05]: Okay. Well we're after okay, we're gonna go into Zecko session at this point, then it's after the consent agenda, so we'll be back. Let's go into Zecco session and and handle our our noted business. Thank you. [0:39:23, 0:39:24]: Is this for [0:39:26, 0:39:30]: Okay. All right, Council, I need a motion to end our executive session, please. [0:39:31, 0:39:42]: So moved. Is there a second? Ms. Ms. Alexander, second then. All in favor, please indicate. All right. All right. Thank you very much for unanimous in that aspect. Now I need a motion to uh reconvene our council meeting, please. So moved. [0:39:43, 0:40:03]: Okay. Miss uh Barber second down all favor please indicate. Thank you very much. And ladies and gentlemen from our segregation session, there's nothing in the sense that we report to you publicly. Uh just wanna let you know that. So we'll move on with our council meeting. And uh we have next is old business, special use permit case sp2024-02. [0:40:03, 0:40:23]: Located in Council District 4 to be considered the board vote only since the public hearing was already held in November 12, 2024. Council consideration of a special use permit request to allow the liquor store on the property 106 Rock Croix Road. Applicant is GRPLLC agent. [0:40:22, 0:40:36]: Uh Mr. Patel. Trying to pronounce your first name as a Humdinger, right? The property is located in Land Lot 62 of District 12, and it contains 0.89 acres. Mr. Anderson, please. [0:40:36, 0:40:42]: Yes, uh this is a continuation of the case that was held in November uh twenty twenty-four. Um [0:40:44, 0:40:46]: The presentation was made in um [0:40:47, 0:40:53]: Towards the end of the presentation and after all the the facts were presented, it was found that the um [0:40:54, 0:40:57]: It was determined that the applicant had code violations that were [0:40:57, 0:40:59]: In the city of Stockbridge Court. [0:40:59, 0:41:11]: Uh we have since got evidence that uh um all those issues have been resolved with the court and the applicant is uh clear to move forward with a special use permit application. [0:41:12, 0:41:26]: And your recommendation, sir, is to Uh the recommendation is still the same from um November twenty twenty four. Uh staff recommends approval. The applicant meets all the requirements of a special use permit according to the City of Stockbridge Unified Development Code. [0:41:26, 0:41:29]: All right, council, any questions that you have for Mr. Anderson? [0:41:30, 0:41:35]: And or if not, is there a motion to approve um this to go forward? [0:41:39, 0:41:41]: Since this is in in my district. [0:41:42, 0:41:49]: I don't support it. I'm going to ask to oppose. That's my motion. Oppose it. Is there a second to that motion? [0:41:51, 0:41:53]: Is there a second to the motion? Certain. [0:41:54, 0:42:12]: Uh the motion has been passed. Uh excuse me, motion has been seconded, excuse me. Excuse me. From Miss uh Barber to Mr uh Mr. Alexander. All right, motion's been made. All right, Ryan, must go ahead please. Uh I would say the applicant wishes to speak [0:42:13, 0:42:13]: All right. [0:42:14, 0:42:16]: Fine. Applicant, come forward and speak, please. [0:42:24, 0:42:38]: No, not a vote yet, but I've I probably should have gave them opportunity to speak prior to taking the motion. I didn't do that. So the motion's still on the floor. The motion's still on the floor. She's speaking on time. It's like just through further discussion. Go ahead, please. [0:42:39, 0:42:48]: Good uh good evening. I'm Lisa Morshauer. I'm an attorney with the law firm of Burman Fink Ban Horn, and I represent Mr. Patel and um the applic the applicant for this. [0:42:48, 0:43:05]: application. Um this is an application that is has been brought forward to you because you voted to allow it to come forward. You had a lottery um because your code says that it once you hit a certain population in size, you have to have um you add another [0:43:05, 0:43:25]: license per certain number of population. And you hit the number and you were able to add two more, you were required to add two more license opportunities to applicants. So this is not something that my client just came up with and said, hey, I want to just come in. It's something that your city council voted to do. [0:43:25, 0:43:45]: And it's because your code mandates that you have it that you allow for the opportunity. So you had very strict criteria about what the application had to include and what kind of application it had to be, where the locations had to be, specifically on Jodica Road and on Rock Quarry Road. [0:43:45, 0:43:48]: Those were the only two locations that an applicant could use. [0:43:49, 0:43:52]: Фортін, а болив, фортін, аплікації сворідфорд. [0:43:52, 0:44:03]: And only two of those applications met the criteria. My client, mister Patel's application, was one of those that met the criteria. It absolutely meets all the criteria to get this. [0:44:04, 0:44:24]: SUP and and get the license. But in order to get the alcohol license, the city code does require that you get a special use permit. So that is why he's standing in front of you right now. He's here, he's back here if you want to speak with him. But he is here because the code does require a special use permit application. [0:44:23, 0:44:32]: I know that you do have discretion in issuing it, but I want I I ask that you consider the fact that the council voted to allow for two new licenses. [0:44:32, 0:44:43]: And this location is a great location. It's on um Rock Quarry Road. It's off the main re m off the main area. It has ample parking. It's a beautiful store. He's taking a location that has um [0:44:44, 0:44:48]: Has been in use as another use, but is renovating it completely. [0:44:48, 0:44:55]: And it isn't um it meets all the distance requirements. It it has um it's an excellent location for this kind of store. It will not [0:44:56, 0:44:59]: Has any traffic issues, it has as I said a lot of parking. [0:44:59, 0:45:19]: Um, I know that there was some issue with his neighbor with a tree, and I don't know if that's impacting the um the motion to not approve it, but that tree issue, my client hired a licensed and bonded tree company to come in and cut down a tree on his own property. Unbeknownst to my client, that company did not get a permit to cut the tree. [0:45:19, 0:45:39]: Down, which he was supposed to have gotten. My client did not know that. He also did not know that the that the tree company accidentally cut down a tree on the other property, not intentionally. My client did not tell him to cut that tree down. So I know that came up before you, and my client went to court over it. I did not go to court with [0:45:39, 0:45:51]: him but he did end up going to court and um that got resolved and and the solicitor found that there was no reason to to charge my client with anything criminal because that it was clearly an accident. [0:45:51, 0:46:11]: And it should have just been handled through the um tree company itself. That's who should have done it. Should they should have gotten the permit and they took responsibility for taking the tree down um accidentally. So that that should not be looked at as my client's uh a fault on my client. And I ask that you not look at it like that. I don't know if that's the reason, but but [0:46:11, 0:46:31]: But this is here because you voted to allow for another license. And this is a great location for this spot. And um I know that I had um previous well, uh another gentleman was here last time speaking on behalf of my client because I couldn't attend. I had a conflict. So Mr. Buckley was here, and I believe he put into the record constitutional objections, which I had also [0:46:31, 0:46:47]: put in at the planning commission. So I want to make sure those are in the record. I have them again just uh to have them. But um but we do ask that you vote favorably for this application because you you granted it, you you granted the opportunity to come forward with applications. [0:46:47, 0:47:01]: And and we ask that you grant it because it does meet all the criteria. He's got he's gonna have a beautiful store. And I think that it will be a very a good asset to this neighborhood. And I I can answer any questions if you have any. [0:47:03, 0:47:05]: Yes, yeah, go ahead, Miss Barber. [0:47:05, 0:47:20]: Hi, thank you. Um so I am the council representative for the area. There was no vote by the council on the location of the two new [0:47:20, 0:47:26]: Look at licenses. So staff they published [0:47:26, 0:47:28]: Um a location [0:47:28, 0:47:30]: In city council district four. [0:47:31, 0:47:31]: That's my district. [0:47:32, 0:47:33]: Each district [0:47:34, 0:47:35]: Was supposed to have [0:47:36, 0:47:36]: At least five. [0:47:36, 0:47:38]: One package door. [0:47:38, 0:47:39]: In their district. [0:47:40, 0:47:41]: Already have one. [0:47:41, 0:47:44]: I already have one that's in City Council District Four. [0:47:45, 0:47:46]: There was no vote. [0:47:47, 0:47:48]: To put a second. [0:47:49, 0:47:50]: Package store. [0:47:50, 0:47:51]: From the council. [0:47:51, 0:47:52]: So [0:47:53, 0:47:59]: The decision by staff to publish or advertise a second location in my district. [0:48:00, 0:48:05]: That was an error or it was at staff's discretion. So my opposition. [0:48:05, 0:48:09]: is in um is the fact that it is in [0:48:10, 0:48:11]: The entryway [0:48:12, 0:48:13]: to our downtown area. [0:48:14, 0:48:16]: I'm the representative. [0:48:16, 0:48:17]: For the downtown area. [0:48:18, 0:48:19]: A package store. [0:48:19, 0:48:21]: It's not something that I believe. [0:48:22, 0:48:23]: Would be attractive. [0:48:23, 0:48:24]: Two [0:48:25, 0:48:33]: New businesses, new investors that are looking to come into our downtown area. Now, of course, I'm only one vote. [0:48:34, 0:48:41]: This is the district that I represent. My councilmates can choose to vote however they decide to. [0:48:41, 0:48:43]: But as for me [0:48:44, 0:48:46]: The businesses that I'd like to see. [0:48:47, 0:48:49]: To help us revitalize our downtown. [0:48:50, 0:48:52]: Don't include a package store. [0:48:52, 0:49:09]: We're looking for something that's gonna help um help us revitalize. And I don't think a package store is gonna bring new businesses, bring new restaurants, that kind of thing. I know this particular location is across the street from an apartment complex. [0:49:09, 0:49:15]: is not only across the street from our apartment complex, it it is um less than [0:49:16, 0:49:21]: I guess a mile, a quarter of a mile away from the forty milyen dollars stem school. [0:49:21, 0:49:22]: That is to be built. [0:49:23, 0:49:25]: It's not only [0:49:25, 0:49:29]: That close to our future stem school, but we have a elementary school. [0:49:30, 0:49:31]: That is a block away. [0:49:32, 0:49:32]: So [0:49:33, 0:49:34]: That is why [0:49:34, 0:49:35]: Our objects. [0:49:36, 0:49:38]: To having a package store there. [0:49:39, 0:49:43]: My councilmates they can choose to vote however they want to. [0:49:43, 0:49:44]: But [0:49:44, 0:49:46]: That's the stance that I'm taking. [0:49:47, 0:49:48]: That's all. Thank you. [0:49:49, 0:49:51]: Councillor, any other questions, concerns? [0:49:51, 0:49:52]: For the applicant. [0:49:52, 0:49:58]: I just have a comment. Go ahead, please. Well mm well, I guess it could be two part it could be a question as well. [0:49:59, 0:50:15]: I heard you speak of the trees, but there was other work that was done on the property prior to um receiving a permit in order to do it that could have messed up some of the drainage flow, um, from my understanding. Some plumbing or some things that were done um [0:50:16, 0:50:36]: prior you know, without big getting a permit to do it, that was one of my biggest concerns. Not necessarily just the trees, but actual work being done on the outside of the building and work being done in the building. That's the accusation that was had that was made. Are you aware of that? And w what was the outcome [0:50:36, 0:50:44]: of that as well. I don't know the answer to that. If you can give me a minute, I'll speak with my client about it. But before I forget my train of thought, um [0:50:46, 0:50:48]: Okay, I know you want to say something here. [0:50:53, 0:50:54]: Absolutely do it. [0:50:54, 0:51:14]: Um you do and that's why. At this time I move to table this until we can have further discussion and bring this back to council at the next schedule meeting. I move to table this until we can bring this back to council after further discussion with council. But but we already got a motion on the floor, sir. Uh there is a motion on the floor to deny. I I mean uh [0:51:14, 0:51:28]: Yeah, I mean there is a motion. It's ultimately council decision about this, but I would discuss that. I will rescind my motion um for further discussions. All right. If she re since she starts since she it was her motion, she can do that. Mayor. [0:51:29, 0:51:30]: I'm sorry. [0:51:30, 0:51:37]: I I move to follow the instructions of our attorney and table this matter until we can have a little bit more discussion about it. [0:51:38, 0:51:45]: All right. And that's that that's legal in that aspect. And uh madam clerk, you have that written down, is that right? Okay. [0:51:45, 0:51:48]: Well, and do you have any idea how soon before we think you [0:51:50, 0:51:53]: I'm fair. Um Mr. Alzheimer's second, all in favor, please indicate. [0:51:55, 0:52:13]: There's an Namus decision, Mr uh Thomas voted to do this as well. Namus decision to have this tabled. You have any idea how soon b how soon you wanna bring about? Council but I'm assuming um the uh February meeting'cause I wanna talk with um community development as well. Okay. I look forward to the February meeting. Thank you. [0:52:18, 0:52:19]: For new [0:52:19, 0:52:38]: Okay, thank you. Thank you. For new business. Appointment of municipal court judge to a two-year term based on House Bill 456. And um our judge Matt McCord is up for renewal for two-year term. Uh so I need a motion to uh accept this appointment for two years. [0:52:38, 0:52:44]: So moved. Mr. G Ms. Gantt, is there a second? [1:02:32, 1:02:37]: Uh, this item went to the Planning Commission on December nineteenth and the Planning Commission recommended approval. [1:02:39, 1:02:59]: Uh to summarize this without reading all this is basically to allow if you're in existing bed and breakfast and you're tenure and your structure's ten years old and you have an existing accessory structure on the property, the same property, same parcel, and um you want to use that as a caretaker home or similar to a parsonage home for a church. They wouldn't be able to rent it out for commercial purposes. They'll only be able to use it for caretaker purposes. [1:04:04, 1:04:17]: Okay, so basically it was nonconforming and you're trying to get uh Yes, it yes it's non confor legally nonconforming, so right, but it's been in operation for now how long? Several years. Several years, yes, sir. [1:04:17, 1:04:25]: Okay, certainly I understand and they've been uh a um positive for the community overall. Not my district, I think it's [1:04:26, 1:04:27]: In district four. [1:04:27, 1:04:28]: Yes. [1:04:31, 1:04:32]: Okay. Any other questions? [1:04:33, 1:04:33]: Yep. [1:04:34, 1:04:43]: Okay. Uh I wanna apologize. I can't really um see. I was here on the nineteenth of December trying to get a understanding of I was just trying to make sure. I know this can't be moved into a subdivision. I didn't want the uh current [1:05:41, 1:05:59]: ordinance to change that someone might be able to buy or purchase something and then it can turn into a bread and breakfast. That's what my opposition was. I didn't have a chance to really um see the um visually reading um um that's why I'm putting an opposition uh for tonight. Thank you. [1:05:59, 1:06:19]: Thank you. All right. On that note, no, I'll close this portion of the uh the public hearing. No, the comments uh council if you I know. I have one comment. Yep, go write it, please. [1:06:55, 1:06:57]: or PUD uh mastered plan development. [1:06:58, 1:07:06]: The intent is to adopt a master plan for the property to allow for the construction of a town home development. Applicant Vista Residential Partners Agent Dennis J. Webb [1:07:07, 1:07:08]: Junior Esquire. Parcel number 030-01002001 contains uh point eight eight six acres. Parcel number zero three zero-one zero zero two zero zero two contains three point nine eight eight acres. Mr. Anderson, please. Okay. Before I begin, uh may [1:07:48, 1:08:08]: Mayor, uh, I like to say that uh this property um was annexed into the city in uh 2022. Um and according to our code and other regulations, um we have to assign a similar zoning. That's that the property was owned in Henry County. It was on mixed use in um in Henry County. So when we brought it in. [1:08:08, 1:08:12]: Um city council voted to approve the zoning maps in the [1:08:13, 1:08:33]: And the land use map, and it was assigned a the zoning of PUD, which is playing unit development, which is similar to the mixed use designation in Henry County. Okay. So uh what precipitated this this uh particular agenda item tonight is all PUD zoning must have an approved development plan or a regular [1:08:33, 1:08:36]: So the zoning isn't in question tonight. [1:08:36, 1:08:38]: Only thing uh council [1:08:39, 1:08:48]: We'll be uh considering tonight is there is approving their master plan or development plan or regulating plan to go along with the PUD zoning. [1:08:50, 1:08:51]: Okay. Okay, excuse me. [1:08:52, 1:09:03]: So uh the property has 18 acres. Currently the property is vacant, mostly level. Uh the current future land use designation is medium density, mixed use. [1:09:05, 1:09:08]: Like I said previously the the the current zoning is PUD plan unit development. [1:09:11, 1:09:15]: Here's a aerial photo of the uh three parcels highlighted in orange. [1:09:17, 1:09:20]: Here's a map showing the three parcels comprising the subject property. [1:09:24, 1:09:25]: Here's another aerial photo. [1:09:27, 1:09:31]: Here's proof of the zoning sign that was posted on November twenty sixth, twenty twenty four. [1:09:37, 1:09:57]: Uh the applicant is proposed to to build a um a townhouse development on flip flipping road at Wall Stevens. Um a master plan. It's a mixed use development. Uh it will it will be in concert with the um the Reeves Creek um master plan that um Reed Creek's development that city council approved. [1:09:57, 1:09:58]: A little over a year ago. [1:10:03, 1:10:04]: Here's the site rendering. [1:10:07, 1:10:09]: Here's the site development data. [1:10:11, 1:10:18]: It will comprise of 94 units, units, proposed unit size, 24 by 50 foot, front load townhomes. [1:10:20, 1:10:22]: Uh front the front yard setback will be fifty feet. [1:10:24, 1:10:30]: Total parking will be three hundred and ninety seven spaces, a hundred and eighty eight is required. [1:10:31, 1:10:35]: Here's a rendering and an elevation of the proposed units. [1:10:40, 1:10:41]: Here's the front elevation. [1:10:46, 1:10:49]: Here's the layout of the interior, the master plans. [1:10:53, 1:10:59]: As you can see the here's the s here's the side elevation, the left side and the right side elevation. [1:11:05, 1:11:21]: So like I previously mentioned, the applicant is here tonight to get uh approval from city council for his uh master plan and uh the UDC requires that all PUD Plan Unit Development Zoning has a regulating plan or master plan assigned to it. [1:11:22, 1:11:30]: So um staff recommended approval with uh conditions. Let me get to the conditions. [1:11:34, 1:11:35]: Uh [1:11:37, 1:11:57]: I'm read the conditions into the record. Um as it relates to the site plan, the developers shall submit and build the proposed development according to a site plan which is very similar in design to the submitted one, which is entitled Flip and Road at Walt Stevens, a master plan mixed use development for visibility partners, conceptual master plan preliminary, which which was [1:11:57, 1:12:02]: Prepared by Planners and Engineers Collaborative on December 6th, 2024. [1:12:02, 1:12:07]: All internal sidewalks shall be shown shown on the site plan with their widths noted. [1:12:07, 1:12:12]: The development the uh as it relates to amenities, the developers shall provide a dowel park, a grilling area. [1:12:13, 1:12:13]: And a fire pit. [1:12:14, 1:12:18]: and connections to the nearby walking trails, and these shall be labeled on the site plan. [1:12:19, 1:12:39]: Setbacks and building spaces. Although the property's PUD zoning does not have a specific setback or building spacing requirement, the proposed setback and building spacing should net should nonetheless be stated on the site plan. Uh requiring 25-foot-wide buffers along the northern and eastern sides of the property, contiguous to the adjacent properties. [1:12:39, 1:12:40]: Which are zone R R. [1:12:41, 1:12:42]: And S R. [1:12:44, 1:12:51]: Uh condition number two, the applicant shall obtain, submit, and comply with the with all terms of water and sewer facilities letter from the Herring County Water Authority. [1:12:53, 1:13:03]: Architectural design, condition number three. Three eight. All town home units shall be a minimum of sixteen hundred square feet in size. All town homes shall have two car garages. [1:13:03, 1:13:17]: All sides of each town home building should have exterior materi exterior materials consisting of brick, stone, or stucco, or any combination of two or more of the fallen materials on all sides. Brick, stone, stucco, or cement fiberboard. [1:13:19, 1:13:23]: Um gates gates shall not be required at the project entrances. [1:13:25, 1:13:33]: Property management. The developer shall establish an HOA or shall secure a property management company to maintain the common areas of the proposed development. [1:13:33, 1:13:35]: Recombination of parcels. [1:13:36, 1:13:56]: The developer shall prepare and submit a clear plat, which shows how portions or parcels comprising development site would be combined. The plat shall be combined, should be approved by the community development department and officially recorded at the Henry County Superior Court. Further, no permits shall be issued for the proposed development until the developer has submitted to community development copy of the [1:13:56, 1:13:57]: Recorded plate. [1:13:59, 1:14:05]: Uh so there was um an additional requirement um [1:14:06, 1:14:07]: That was presented. [1:14:09, 1:14:15]: the staff uh add wants to add um it relates to the um [1:14:15, 1:14:19]: Rental cap, uh no more than ten percent. [1:14:20, 1:14:24]: of the total number of proposed development shall be rented. [1:14:26, 1:14:27]: So that's it. [1:14:28, 1:14:48]: Thank you for that, Ms. Mr. Anderson. Um that additional um percentage, ten percent of rental cap, I'm assuming that the applicant is uh minimal to that, right? Uh no, that's staff's condition based on some other re requirements. Okay. Uh and other concerns. [1:14:48, 1:14:51]: concerns that were passed alone at the planning commission. [1:14:52, 1:14:55]: I see. So th but they're all negotiable. [1:14:56, 1:14:57]: And subject to approval by counsel. [1:14:58, 1:14:59]: Okay. [1:15:00, 1:15:04]: Does the applicant have a presentation as well? Yes, sir. Okay. Why don't you come forward, sir? [1:15:12, 1:15:32]: I got I got a question for staff. Go ahead, please. Mr. Anderson, uh you have indicated as far as this is concerned, the rezoning has already taken place, right? Yes yes, sir. So the council has already voted. So the project, the rezoning or are has already taken place. So that's approved. Yes. So basically [1:15:32, 1:15:52]: They uh but because we put in more stringent standards that we have to have a development agreement in place, a master plan agreement in place in order for them to go forward. But the rezoning has already been approved. Is that correct? Yes, sir. [1:15:52, 1:16:02]: It was rezoned when it came in through the annexation in 2022. It was it was mixed use in the county. But when it came into the city, it received the City of Stockbridge mixed use designation, which is PUD. [1:16:02, 1:16:22]: And code requires all that all PUD zoning in the city of Stockbridge have a regulating plan or a master plan or a development plan assigned to it. Right. So in other words, what has happened is we've already approved the zoning for this particular development and then uh in accordance with what we had actually approved across the street. Yes, sir. [1:16:22, 1:16:39]: But this particular portion did not have a development agreement which we're trying to put in place to make sure that they have the highest standards appro uh and appropriate to where we're trying to go in the city. Exactly. That's correct, sir. All right, thank you. All right. [1:16:40, 1:16:45]: Do you have a question for Ms. Anderson? Yeah. Go ahead, Ms. Anderson, come back please. There [1:16:45, 1:16:54]: Um, Mr. Anderson, um one of the questions that were asked in regards to this light plan was whether or not amenities would be provided. [1:16:54, 1:16:56]: The response was that this [1:16:57, 1:16:57]: Um [1:16:59, 1:17:08]: The mit whether or not amenities will be provided. And the response says this was noted in the pre application meeting and in the statement of intent. [1:17:08, 1:17:28]: The residents will have a sidewalk connection to the adjacent Riv Reeves Creek Trail. Is that the only amenities that are gonna be? No, they'll they'll they'll be able to share in the amenities in the in the development that we approved over a year ago. The thirteen hundred uh unit project that's across that's that's across the street. They will be able to share in those amenities and also [1:17:28, 1:17:29]: Um [1:17:30, 1:17:35]: Uh they have uh I I listed several amenities in the conditions. Uh let me go back to it. Um [1:17:43, 1:17:50]: Uh it will it would have a dog park, a grilling area, and a fire pit in connection to the nearby walking trails. [1:17:50, 1:17:55]: And uh all those shall be labeled on the site plan. That's condition one C. [1:17:56, 1:17:56]: Okay. [1:17:56, 1:17:57]: All right. [1:17:57, 1:18:17]: Now what you're saying pretty much is the neighbors they will be able to walk out pretty much uh onto the trail and connect to Rees Creek Trail from their neighborhood. Yes, sir. Which is a highly desirable amenity that we kind of look for. I guess the only things that we always concern ourselves with is to make sure that we have [1:18:17, 1:18:35]: Have that connection so that people aren't walking in the grass on flipping road. They're gonna have a ten foot path along uh flipping road. Yes, yes. So and then they will also have an internal connection to the r the Rees Creek. Um on one side, right? [1:18:36, 1:18:37]: The internal connection. [1:18:39, 1:18:40]: How cold is that? Uh [1:18:42, 1:18:44]: Not an inside, it's too small. Um [1:18:45, 1:18:46]: Let me go back to the layout. Um [1:18:49, 1:19:04]: But basically the front trail, well maybe the the ten foot path would connect to Reed's Creek. It would basically give people to the north of that the ability to have a sidewalk where now they don't have one. Yes. [1:19:07, 1:19:08]: Is there way you can bloat it up anymore? [1:19:09, 1:19:10]: Uh y yes, sir. [1:19:25, 1:19:32]: I notice the parcels are not conti don't connect really. How are they doing what are they doing for connectivity? [1:19:34, 1:19:37]: Uh when you say they don't connect, uh [1:19:38, 1:19:43]: I there were oh okay. Is that the there wasn't one on the other side or is that something totally different? [1:19:44, 1:19:45]: On the other side of the street. [1:19:45, 1:19:46]: No. [1:19:46, 1:19:48]: Phase one. [1:19:49, 1:19:55]: I see one, two, and then I see a big gap and then I see some more houses. Yeah, that's a street. [1:19:56, 1:19:57]: Fairhaven Road. [1:19:57, 1:19:57]: Okay. [1:19:59, 1:20:01]: And that's the hammer head right there. [1:20:02, 1:20:02]: Okay. [1:20:03, 1:20:08]: Right, but along flipping drive I don't see uh there's a ten foot path along flipping road. [1:20:08, 1:20:17]: Uh. Well that would need to be a f ten foot path along. Right, in order to connect to Reed's Creek, which is right next door. Yes, sir. [1:20:21, 1:20:33]: This is just showing this particular d the interior, this particular development doesn't uh sh show anything along the frontage right there. But Right. With the flop camera requirement, is that one of the conditions also? [1:20:34, 1:20:40]: Uh this came in bef before our new ordinance, but I'm sure they will they they will agree to it. [1:20:41, 1:20:43]: And street lights. Yes, sir. [1:20:46, 1:21:06]: Uh the only other thing that I saw, okay, that brought up some concern was the minimum square fitted at sixteen hundred. I think in the new code we wanted eighteen. The new one requires eighteen hundred. Right. So they can't the application came in before I'd like to ask'em to go to eighteen hundred. Uh Chase. Are they required to do two cards? Excuse me. [1:21:06, 1:21:07]: Yeah. [1:21:07, 1:21:22]: They uh they I'll let him address it during his presentation, uh uh Councilmember Alexander. Yeah, if you yeah, let him do his presentation. Uh keep your question, let him do the presentation. That's our new standard. [1:21:23, 1:21:43]: Uh good evening, everybody. My name is Den Webb, 1105 West Peace Street Street, Atlanta, Georgia, 30309. Here on behalf of Vista Residential. I've got Chase Beasley with me as well. Chase is a managing director with Vista and is ready and willing to take your questions. Let me hit on a few things that were brought up uh just a second ago. Number one, it is our intent to have eighteen hundred square feet as the minimum. We would like a little flexibility, even if one [1:21:43, 1:21:49]: dot drip down to 1775, you know, we'd like that flexibility. I think we could move the number up from 1600. I think that [1:21:50, 1:21:56]: But eighteen hundred is our intent on this property. But uh uh real qu I think staff has ten percent administrative. [1:21:58, 1:22:13]: authority, so that would take you So that's about right slightly uh lower than that, but eighteen hundred is where we really want to be at. Okay. If you ask me, you know. We've been getting the cookie cutter town homes and we wanna do something better than that, you know. [1:22:14, 1:22:23]: What you pictured was nice at eighteen hundred square feet. So so staff has discretion to reduce a zoning condition from eighteen hundred to ten percent less. [1:22:26, 1:22:28]: Okay. We can live with that. [1:22:28, 1:22:36]: We can live with that. Uh couple other things. We do have pass in front of both sides of the development. I'll talk a little more about more of that uh a little bit more about that. [1:22:37, 1:22:47]: You okay with that? Right. Uh uh actually I I do have some some conc conc concerns and questions, but I wanted him to uh do his presentation because he may [1:22:47, 1:22:53]: He may uh speak on some of those. No. I hope I do. I'm just waiting on you to do your presentation. [1:22:53, 1:23:06]: Okay. Uh just I I I just to clean up and touch on a few more things that were raised, we do intend to put pass in front of the north and south side of that townhome. We don't really have a way to connect internally. We don't actually own all that property in the middle. Some of it's owned by Stockbridge, some of it's [1:23:06, 1:23:26]: floodplain, but we do have a path going down along Flippin' Road on both sides of the development. And lastly, I'm just gonna mention we you guys talked a little bit about this property and how it got into Stockbridge. I'll talk about that a little bit more in a second, but just back in 2019, this property was zoned for a hundred townhomes. And as Mr. Anderson talked about it was zoned in [1:23:26, 1:23:42]: MU and when it comes into the city, it's got to have a comparable zoning district. PUD was the only option really. And there's one difference between Henry County's MU district and Stockbridge's PUD district, and that is you've got to have a regulating plan. And Mr. Anderson covered that well. [1:23:46, 1:24:01]: As you guys heard and know, Vista is developing 290 acres right across the street, right? We went through the we filed an application to annex into the city of Stockbridge originally. We filed a rezoning application as well. Uh the rezoning was approved about a year and a half ago. [1:24:01, 1:24:11]: We would have brought this property in two, but we couldn't meet the annexation requirements. Uh there were some issues, you know, there are contiguity requirements and other requirements under the uh state annexation. [1:24:11, 1:24:31]: code that we couldn't meet at the time we started Reeves Creek One on the West Side. But since then you guys had a referendum and brought in a number of properties into the city, including this. So that's what allowed us to move forward. We would would have liked to have done them together. We just couldn't do it at the time. But Okay, for clarification, that that's the key point that I I just want to make sure that I [1:24:31, 1:24:51]: You we annexed this property into the city, or the citizens did. Correct. They voted to. That's correct. And this is why you're allowed to do this now, where previously you wasn't, because the people voted to annex all of this property into the city. Right. We would have been able to do this development in Henry County. Right, but not in Stockford, though. Correct. That's exactly right. [1:24:51, 1:25:11]: Right. And so yes, this came in and became part of the city on January one, twenty twenty three, is because of the referendum. The citizens voted to take this property into the city. And of course everyone or well not everyone, but you know, it was known what was approved for this property at the time of the annexation. It had already gone through the process in Henry County about four years previously. [1:25:11, 1:25:26]: For further clarification. So basically you had already been approved in Henry County, then it got annexed. This is what triggered all of this. That's exactly right. Okay. I do now clearly understand I I that's something I didn't previously know. All right, thank you. [1:25:26, 1:25:34]: Uh you see here a zoning map, it just shows the parcels outlined here. Again, uh, I'm gonna try and not step on or cover the same ground that Mr. Anderson did. [1:25:35, 1:25:35]: Um [1:25:36, 1:25:52]: Here is the site plan. This property is of effectively three tracks. They total eighteen point three acres. Uh and as was discussed, the the tr site is bisected by Reeves Creek, the Reeves Street Trail Trail, and Fairhaven Road here. So there are some separation points. [1:25:54, 1:26:14]: Uh as you heard the intent is a ninety-four unit townhome development. We're actually pro f uh uh seeking six less than that were than were approved by Henry County. All will be two-story, all will have two car garages. In terms of the access points, if you look here to the north side, you'll see that this area is cut by Fairhaven Road and we have driveways directly. [1:26:14, 1:26:28]: onto Fairhaven Road. To the south, we have aligned the driveway there with an intersection of the new Rees Creek development. That intersection will be signalized, right? So there's gonna be a traffic light there, which I think is a great option for these folks coming out of the development. [1:26:30, 1:26:30]: Yes, ma'am. [1:26:40, 1:27:00]: So this is the intersection I was just talking about. Uh you'll notice there is a left turn lane that's being added flipping the road because of the development across the street. Uh it doesn't show on here, but there will be a signal here uh as part of the development uh that will be coming through here shortly. By the way, Reese Creek One just got the LDP last week. We have been working almost every day. [1:27:00, 1:27:14]: Since we left this uh location a year and a half ago to try and get that LDP and we're proud to say that it we have it. So you'll start to start to see some activity. It wouldn't be for did you say that would be a signal? Yes, sir. A traffic stop a traffic light. [1:27:14, 1:27:26]: At uh Fairhaven. Yep. So this new driveway coming out of Reeves Creek One will have a traffic signal here and it will align with the driveway coming out of the south side of the development we're here to talk about tonight. [1:27:27, 1:27:28]: Yeah. [1:27:30, 1:27:40]: Because oh I'm I'm trying to get some clarity on on the traffic signal. So h how how does it align with Fairhaven [1:27:41, 1:27:46]: Well let me back up. See I do understand that we you know, we got Reese Create One. Correct. [1:27:47, 1:27:57]: Which is on the other side of flipping and all been completed now. So now we're talking about the right side of flipping. So if you got a traffic traffic signal [1:27:58, 1:28:00]: Fair Haven. [1:28:00, 1:28:01]: What is it aligned with? [1:28:02, 1:28:15]: On the other side. So if you you see where my cursor is right here? Right. So Fairhaven is actually up here. This traffic signal will not align with Fairhaven. There is no driveway on the other side of Flippin' Road to align it with. [1:28:16, 1:28:21]: So the driveway coming out of the south side of this development will line up with the driveway coming out of [1:28:22, 1:28:35]: Uh Rees Creek One. One. And at that intersection there'll be a light. You'll notice too we've added a left turn lane into the property. Uh here there is a deceleration lane coming into the site. All with the these were really uh [1:28:35, 1:28:45]: largely recommendations made as part of the DRI process uh that was performed to, you know, try and minimize and mitigate the impact that this these developments would have on flipping road. And there are [1:28:47, 1:28:55]: There th this is doesn't show all of Rees Creek West, but there's another uh access point up here and again like like [1:28:55, 1:29:06]: the access point to the south, it's got a turn lane into the property and deceleration lane. So folks trying to get into the property will get out of the flow of traffic and allow those just coming through the area to continue to move. [1:29:06, 1:29:14]: Well that was a part of my question, but I I'll let you c complete your presentation. Okay. Uh and and I'm I wanna answer every question you got. So uh [1:29:15, 1:29:35]: Don't hesitate. Uh this is the same set of elevations that Ryan just showed. It's you'll see a combination of brick, stone, stucco, and cement fiber board. Uh Councilman Alexander has asked about making these overhangs metal. Uh we're agreeable to that. Uh and we could add a condition uh at the end of this process if if that is the the council's desire. [1:29:35, 1:29:36]: Um [1:29:46, 1:29:53]: Let me just tell you about how we got to here because there's actually a code process uh to uh approve a master plan. You know, as you've heard. [1:29:54, 1:30:14]: We got the zoning we need, it allows us to build townhomes at the density we want. But uh because of the PED requirement, we have to have a master plan. And then just so you know, this is how it works. It starts with staff. We submit what's called a concept plan to staff. And they provide feedback to us and we work together to finalize that and and and and basically transform that concept plan into a master development plan. And we've now [1:30:14, 1:30:19]: done that. Both sides are satisfied with what we're presenting to you tonight and that's what are what we're asking you to approve. [1:30:20, 1:30:20]: Uh [1:30:20, 1:30:25]: Mr. Anderson went over the conditions. We're we're we're we're okay with them. Um [1:30:26, 1:30:46]: Uh we do have amenities. We asked for a change. The initial uh a request for amenities uh included picnic tables and a barbecue, and that's not exactly what we're trying to do here. We do have a uh a grilling area, we've got a fire pit, uh, but we wanted to refine that a little bit and and uh staff has agreed with that proposal. Again, uh we've uh told mr uh councilman [1:30:46, 1:30:58]: Uh Alexander, that uh we're okay with metal uh roofs on the overhangs. I guess the only other thing I would talk about there was reference to sort of conversation about rental restrictions at the planning commission. Let me tell you a little bit about that. So [1:31:00, 1:31:20]: Staff had recommended a 10% rental cap, uh uh, which for a for sale product we're perfectly fine with, right? But we did raise the issue because there's a possibility that an institution could come in, buy this entire development, maintain this entire development, and and and might be interested in renting it. So the our our point was that's the [1:31:19, 1:31:28]: That was the reason we debated it. You know, w we would never allow you know twenty individual homeowners to come in and rent out twenty units. That will never ever happen on this property. [1:31:29, 1:31:49]: If this is a for sale product, there will be a strong uh rental cap. Uh if it's if it's institutionally owned, you know, we didn't see a problem with one company owning the property, one company cutting the grass, painting the walls, dealing with all these issues. Uh but again the the planning commission didn't seem to have a problem with it. There may be a problem here. Uh [1:31:49, 1:31:57]: Tonight, I don't know. We we were okay getting imposing the rental cap of ten percent on for sale units if that's the direction you wanted. We we thought it would be [1:31:58, 1:32:14]: at least worth c having a conversation about institutionally owned. I mean that's that's the dream, frankly, for this kind of development because it's maintained by a well capitalized, well organized entity. But i if if it's the will of the council that we have a ten percent rental cap, that's fine. Again, uh [1:32:16, 1:32:25]: We're okay with staff conditions as proposed and we are open to uh an additional condition that requires the overhangs to be metal. [1:32:26, 1:32:43]: I kinda got shorted on time there, but I was gonna say council you we'll give'em extra time. I'm assuming the extra time for you. If you need still extra time to make your presentation, we'll have several questions of course. Well it came out a disjointed way, but I I I've said what I need to say and and so I'm happy to answer any questions you have. Let me let me start with Mr. Thomas. Mr. Thomas, you got something else? So [1:32:45, 1:32:46]: I do understand uh [1:32:47, 1:32:56]: I do understand Reese Creek one, and we're talking about two. I do understand, even though [1:32:57, 1:32:58]: You know, um [1:32:59, 1:33:01]: The developer now didn't get us a chance to really to talk. [1:33:02, 1:33:12]: But I do understand when it was in Henry County and with the annexation then it required the master plan. So going forward from that point [1:33:13, 1:33:15]: You mentioned the traffic light. [1:33:16, 1:33:36]: So my questions are really centered around the road improvements. And uh I'm gonna ask Mr. Anderson here in a minute. I recall a conversation of a joint um a joint project with Henry County and the city. [1:33:36, 1:33:37]: [5618.2, 5621.1]: to White and Flip and Roll. [1:33:42, 1:33:43]: Um [1:33:43, 1:33:48]: Number one, I'd like to know where that is. And the reason I'm going there is because [1:33:49, 1:33:53]: When you start developing sidewalks [1:33:53, 1:34:10]: uh turning lanes, et cetera, et cetera. So if there's a future plan to widen, how does all of that affect that? And so maybe uh Mr. Anderson, maybe Mr. Gardner, or do you have any history [1:34:10, 1:34:13]: on the joint project with Henry County and Stockbridge to widen [1:34:14, 1:34:23]: Flipping road. I I'm gonna ask Chase to come up and talk a little bit about that because he I think he's been part of some conversations. The one thing I can tell you is we have heard about that and we have allowed sufficient right of way [1:34:24, 1:34:33]: to uh accommodate those changes in the future. Well that was my concern. So our our buildings and whatnot are set far enough off the roadway to allow for that widening. So even with the [1:34:35, 1:34:38]: It he can get ready to come forward because that's what some of my concerns are. [1:34:38, 1:34:42]: Um, the widening [1:34:42, 1:34:43]: Um [1:34:43, 1:34:58]: that would include the sidewalks, that would include the turning lanes, the ingress, egress. So all of this is is accountable for for as uh having the the footage to to do all of this, even though [1:34:58, 1:35:07]: Uh the widening may come years, years later, but it is allowed for. That's correct. And so Mr. Anderson. Go ahead and [1:35:10, 1:35:12]: Okay, go come come to the mic surf, please. [1:35:15, 1:35:35]: And if you would, could you speak to a little bit more in depth of some of the uh roadway improvements? And I know um the first gentleman he saw to mention some of that with the traffic light and and the turning lanes, but can you give us a uh a a better picture of uh the roadway improvements? Sure. Chase Beasley with Fista Residential. [1:35:35, 1:35:55]: Um back to your question about the roadway widths. We have uh seen a few preliminary design um analysis on what we need to accommodate. And so as a part of our land disturbance permit and working with Ryan and his his great team, we have gone ahead and accommodated the appropriate width. So there shouldn't be an issue. Your concern is very valid as far as uh ensuring that [1:35:54, 1:36:14]: There's adequate uh right-of-way width for when those improvements are made. Uh however, um now moving back to our plan here and back to Din's point, if you could see the cursor, the roadway improvements are shown here in the bolded line. Let me see if I can zoom in a little more. [1:36:15, 1:36:35]: We have a traffic signal on the southern entry to the already approved east flippin', I'm sorry, west flippin' development here. This regulating plan for our townhomes here, which is the subject tonight, will align directly with this signalized intersection here. The signal intersection [1:36:34, 1:36:54]: Is code compliant. We've worked with your team. It's been approved. We've been very detail-oriented to ensure that that is compliant as stated. Moving up, we have another. This is Fair Haven. We will not have any direct access on a flip-in from these two teams. [1:36:54, 1:37:14]: Townhome, we'll call them pods just because of how they're broken up. The connection points are off Fairhaven. Um, and then going back to historic um traffic improvements that are are will be aligned with the southern entry here. We have a northern entry into a west side of Flip In, which is Den alluded to. We'll have a deceleration list. [1:37:14, 1:37:34]: Lane and a left turn lane to ensure that traffic flow for anyone going into the West Flippin development is off of the main road. So I'm more than happy to send you a more detailed site plan showing those improvements, but all of the improvements are or happening. [1:37:34, 1:37:40]: have been worked with the staff. Uh they also have been approved by the uh Greta team as well. [1:37:41, 1:37:53]: So so the turning lanes I I I do understand uh the turning lanes at the light, the traffic light, uh but you mentioned um an entryway [1:37:54, 1:37:56]: Yes. So [1:37:57, 1:38:02]: I'm sorry to interrupt. Go ahead. So um there are turning lanes there as well. [1:38:02, 1:38:22]: Correct. It's just off the page. I mean, th this this is designed to show you what we're here to talk about tonight. So it doesn't include all of the West Flippin. But if off the page up in this area, there is a a second access point that will have a deceleration lane into it and a left hand turning lane that will be added to flipping road. Mm-hmm. It's just not showing on very strong. And [1:38:22, 1:38:29]: And and are there sidewalks on both sides of uh flipping? Yes, sir. Okay, okay. [1:38:29, 1:38:37]: Well, uh I I think with the conditions and some of the questions that uh council members asked. [1:38:37, 1:38:50]: Uh, I was just a little concerned about the um roadway improvements and the fact that there's a traffic light on flipping. God, I mean that is [1:38:51, 1:39:01]: That is going to be monumental right there. Um so let me ask um Mr. Anderson, uh is there a timeline? [1:39:03, 1:39:06]: Right, and then I want to ask Mr. Gardner. [1:39:07, 1:39:10]: Uh, is he a part of the conversation with Henry County? [1:39:11, 1:39:19]: uh as far as uh the project itself. And the reason I want to emphasize this issue right here because um [1:39:20, 1:39:25]: not even getting into the the criticism of everything. [1:39:25, 1:39:45]: But being able to put in those roadway projects, I think that is what's going to be instrumental in whatever we do. I think the traffic light, I think the sidewalks, the turning lanes, I think all this is very important. And so um uh [1:39:45, 1:39:55]: Mr. Gardner, do you do you have in information as far a timeline? And what is so the city of Stockbridge and Henry County, are we working together? [1:39:56, 1:40:16]: Presently. We have, but I don't uh we haven't discussed the particulars as it relates to flipping and the improvements in on flipping road. Um, because you know the biggest barrier to improving flipping road is the interstate. So you when you get to that point once you cross over banks, if you're [1:40:16, 1:40:17]: Do any widening in there? [1:40:18, 1:40:24]: You're gonna have to do something with the interstate because the way that is built, it restricts you widening, flipping road at that point. [1:40:24, 1:40:27]: So that's gonna take uh Herculean effort. [1:40:27, 1:40:45]: Obviously to deal with the feds. So you're talking about down under the bridge. Yeah. That's the only way you can actually widen to make it truly a kind of like Highway forty t what they're planning for Highway Forty two to fall in it. The problem with falling and flipping from North Henry Boulevard down to [1:40:45, 1:40:53]: Let's say Jonesboro Road um McCullough Road. Right. Or or eventually to Jonesboro Road,'cause I think you they're making that extension now. Um [1:40:54, 1:41:06]: Is the fact that the interstate is gonna be a big barrier as it relates to that because you don't have enough space without them doing actually making some improvements on the interstate itself to allow for you to facilitate [1:41:06, 1:41:24]: getting extra room um right aways in there to make that happen. But I think that the effort that they're doing here, um, obviously I think Henry County's been aware of some of this request because when it was in the county, I think some of these items were discussed at that point and how they would make any improvements in the road. So we'll be working with them as it relates to that. [1:41:25, 1:41:32]: So there are no um contingencies as far as the traffic light is proved and [1:41:36, 1:41:56]: I was just gonna add to that and say that Vista as part of its development on the west side will be installing the traffic light and it will be installing the the turn lanes on both the north and south entrances and the sidewalks. So some of these things I know are require coordination between Henry County and Stockbridge, but those elements will be actually installed by the developer as part of the development. [1:41:56, 1:41:57]: We won't have to wait for Henry County or anybody. [1:41:58, 1:42:09]: Right. So in in the master plan, um you pretty much have highlighted all of the different changes from uh [1:42:10, 1:42:30]: The PUD when it was Henry County and now the requirements now that it's in the city of Stockbridge. So for us the master plan, um you have sort of highlighted all of the changes. Oh, that's right. So let's see if this is embedded. Yeah. So just a reminder, because of the [1:42:30, 1:42:39]: The size and scope of this project, it did classify as a development of regional impact. So not only did Henry County get to view it. [1:42:39, 1:42:57]: Um also uh GDOT, ARC, and Greta um were all part of the evaluation because it's a development of regional impact. Um and as part of that process, Clayton County would have gotten every city in the in the vicinity of plus Clayton County. [1:42:57, 1:42:59]: Maybe even the cab might have. [1:43:00, 1:43:20]: Um gotten notification of this project as part of the DRI process to get any feedback from those communities as it relates to the the traffic. But definitely everybody had an opportunity to any improvements that are being made. And GDOT some not GDOT, but ARC does require you to go through and make traffic improvements as possible. [1:43:20, 1:43:35]: of the development itself. So as part of that scope and it went through that, it went through that as part of Henry County, which means that those traffic improvements um came over with this application. Um and we've held them to'em. [1:43:35, 1:43:53]: Right. And I'm I'm glad you mentioned that. So my my only concern was the uh the roadway projects. And I think b all of you are sort of answered my questions and seemed like um um i everything is gonna be pretty much doable. So mayor I yield back. Thank you. [1:43:54, 1:43:56]: Oh yeah, go ahead, Mr. [1:43:56, 1:44:10]: Let me let me say this real quick. I was actually watching the Henry County uh meeting uh the other night and there is some exciting news. There's a Flippin' Road extension that's gonna take Flippin' Road from where it ends right now all the way to Jonesboro Road. [1:44:11, 1:44:31]: That section is gonna have a bridge, it's going to have sidewalks. Uh Commissioner Lewis uh uh was is leading the way on that. So there was a discussion about what it what it well if it was going to be on the other side, they would have to widen the bridge. So certainly, as you say, the state looked at this entirety of the entire area. [1:44:31, 1:44:43]: and knew that all of those are uh potential projects. What we have to do as citizens and as representatives is that T Splash two is coming up. [1:44:43, 1:45:03]: There will be another T sploss. Right. The first T sploss has Rock Quarry Road widening on it, which will actually start this year in the spring. So T sploss two would actually be able to provide the funding for us to widen it. I know Commissioner Robinson was trying to get the design money into uh the SPLOS. [1:45:03, 1:45:23]: I'm not sure whether that made it or not, but I know there was some serious discussion on it. And they even mentioned putting it in the next T-SPLOST as a count as a joint county and city project. So that would be one that we would both want to put a uh a bullet point on and say that uh to the citizens when the next T splot, because T Splash. [1:45:23, 1:45:43]: is something they already paid now that they would have to reauthorize when it comes back up. And this should be the top project that would be on there with everything that we have going on. So uh again, understanding that it's only gonna be in an evolving process of always staying engaged as the citizens would do in order to make things happen [1:45:43, 1:46:03]: Because the growth is going to happen. We just gotta be, we gotta understand that and we gotta manage it the best way that we possibly can. And I'm glad Councilman Thomas has been in in looking at this project and looking at it. And it certainly is. I did not know a full traffic light was gonna go there. So certainly this is exciting to have. [1:46:03, 1:46:07]: Yeah. [1:46:10, 1:46:11]: Anybody else, any other questions? Council? [1:46:13, 1:46:30]: All right. So this is uh this ho this is a a public hearing. All right, so uh if you get that time. So anyway, uh comments uh f um for uh this particular project, for this particular project on my on the very uh left. [1:46:30, 1:46:31]: Anybody in the middle? Four. [1:46:32, 1:46:35]: Anybody four. Four. Positive comment. Four. [1:46:35, 1:46:39]: Are you for the project? Are you good o okay, okay, okay. [1:46:39, 1:46:46]: And and on the right side, four. All right. Anybody oppose the project on my far far left. Any oppose the project in the middle? [1:46:47, 1:46:54]: Okay. If c line up on the side over here. Line up on the side. Anybody on my far right that's oppose the project? Okay. So [1:46:54, 1:47:00]: We'll take the first sir go ahead. Whoever's first? Yeah. N name and address, please. [1:47:05, 1:47:25]: Good evening. My name is Jocelyn Williams, 190 Banks Drive, Stockbridge, Georgia. Excellent presentation tonight. However, I am in complete opposition to this rezoning request from the PUD to a PUD master plan development because it would place a hardship on the surrounding area. [1:47:25, 1:47:45]: thinking that 270 plus 94 would be over 300 new residents. And I know that we're talking about traffic lights being installed, but I would like to get more information because it would negatively affect the property that's um not in alignment with the improvement of the roads. [1:47:45, 1:47:55]: [6475.7, 6488.2]: Red Oak where I live and Walt Stevens. So I would like to get more information how these two Reeves Creek would join together with the three hundred new residents that we'll be welcoming to our area. Thank you. [1:48:09, 1:48:13]: Thank you. In person. Name and address, please. [1:48:14, 1:48:21]: My name is Courtney Hunter, State 164, Titan Road, Stockbridge, Georgia, and I am in opposition of the rezoning case RZ. [1:48:22, 1:48:24]: Dash two zero two four dash eleven. [1:48:24, 1:48:31]: Um I feel that basically flippin' road, when you turn off Walt Stevens, where that sign is is where they're supposed to be building. [1:48:31, 1:48:32]: Both of these properties [1:48:33, 1:48:40]: The traffic is already congested on Flippin' Road. They don't have any details of how they're gonna widen this road. [1:48:40, 1:48:44]: how they're gonna put the traffic lights there. You also gotta look at water. [1:48:44, 1:48:50]: Problem stormwater management, traffic utilities, the environmental impact. [1:48:50, 1:48:54]: Um actually traffic and safety, emergency vehicles. [1:48:54, 1:48:59]: Basically stress when you're looking at the traff the street right now, they have daycare a daycare center. [1:49:00, 1:49:12]: on that street and you also have to factor in when people are coming off Walt Stevens and they're turning right, you're now getting into that traffic where border farms subdivision is, where people are trying to use shortcuts to get to the expressway. [1:49:12, 1:49:18]: So you're basically trying to incorporate two subdivisions on a street that's already stressed out. [1:49:19, 1:49:21]: I just feel like you should listen to the community. [1:49:21, 1:49:32]: You ask us to vote for you. I just ask that you please listen to us and listen to our concerns when it comes to building subdivisions. It's already packed there. Traffic is a mess. [1:49:32, 1:49:45]: Flippin' Road is always packed. So it's kinda like if you don't live in this area or near here, you're not experiencing what we're experiencing. And so I'm just asking if you would just please delay this or deny it. [1:49:45, 1:49:48]: Until further more detailed information is provided. [1:49:49, 1:49:57]: To where we can feel comfortable enough to say, yes, we're so we're okay with this subdivision. Thank you very much. Thank you. Sir, name and address, please. [1:49:59, 1:50:19]: Uh my name is Willie Carter, uh address one twenty three Wilson Avenue. I uh oppose this this project. Um I'm gonna rebuttal to um Alexander. Yeah, w the residents not afraid of growth, but you have to do this from a logical standpoint. Seem like the growth that's been going on along with flipping road has been no logic from [1:50:19, 1:50:29]: from n uh I don't wanna say none of you, but mo most of you from up there. So so you got to do stuff, you're gonna do something to have with some kind of logical or with some kind of consideration. [1:50:30, 1:50:35]: Nothing on flipping road is it sh needs to be uh uh [1:50:35, 1:50:47]: Anything else should shouldn't come on Flippin' Road until you do some kind of infrastructure. The infrastructure for Flippin' Road is not there from North Henry all the way to Hudson Bridge. It's not there. The infrastructure is not there. [1:50:47, 1:50:50]: It's not even gonna be sustainable to for what it is now. [1:50:50, 1:50:52]: to which I was talking about bringing in a new sub. [1:50:53, 1:50:55]: And you haven't got the proper infrastructure in right now. [1:50:58, 1:50:59]: You're not you. [1:50:59, 1:51:19]: Oh, thank you very much. Um Ryan, yeah, yeah, gentlemen, why don't you come back to Poldum, all three of you? And uh Mr. uh um Gardner as well, please. Um a couple of things. Um just to make sure that we caught this, I guess. Um the widening there is a plan to widen [1:51:19, 1:51:39]: That's under construction. Right. Okay, so when it comes to uh say Walt round Walt Stevens as you as you go south, excuse me, south. [1:51:39, 1:51:47]: uh towards Hudson Bridge. I mean that's something once again that's in and that's that road is in and out. That area's in and out in the city and in the county. [1:51:47, 1:51:49]: All right, it goes in and out. So [1:51:49, 1:52:01]: Once again, uh besides uh anything that Mr. Alzheimer may say, how about you, Mr. Gardner? You know anything else or Ryan, anything else in reference to what the county's saying about that particular part of the road, anything in the same nature? [1:52:01, 1:52:06]: And and and Hudson Bridge. Hudson Bridge. [1:52:07, 1:52:16]: No, widening of um no, other than they're gonna make some improvements as it relates to side sidewalk, but repaving of the road. [1:52:16, 1:52:23]: Um, as I mentioned before, that area is gonna be problematic for widening because you have to take into account the inner state. [1:52:24, 1:52:26]: You can't there's not enough room to put [1:52:27, 1:52:29]: Two additional liens or three additional liens. [1:52:29, 1:52:40]: under the interchange. You just drive it yourself and you could see the walls from both sides, you'd have to move those which require you to go through a federal process in order to make that happen. Okay. Um [1:52:41, 1:52:41]: You know [1:52:42, 1:52:46]: I know people say, you know, beat the roads, but unfortunate [1:52:47, 1:52:52]: This council, like all councils outside of the city of Atlanta. [1:52:52, 1:52:54]: Um and a few others. [1:52:55, 1:52:57]: Кана так інте акаунт род'. [1:52:58, 1:53:10]: or schools in zoning decisions. Um that's the state law. They are bound by state law when it comes to that. If that was the case, yes, we would have been doing that years ago. Um [1:53:10, 1:53:25]: And unfortunate because the people that own the land who's been here for years and years and years have a right to sell their property obviously for for the highest and best use and sometimes it includes selling it to developers. That's how most of us got here. Um [1:53:25, 1:53:45]: But the key is, I think the developer is showing that and it's required, they're gonna be required to make some improvements along um Flippin' Road from North Henry Boulevard to going towards the intersection of Walt Stevens and Red Oak Road in order to make this development happen. [1:53:45, 1:53:55]: and hopefully over time those improvements will the county be able to make it happen. But the biggest barrier you're gonna have once you go south of the intersection of Walt Stevenson, [1:53:56, 1:54:00]: Walt Stevens and um Red Oak is the interstate. [1:54:00, 1:54:20]: Th there's news on that too. Right. So so really well yeah, the the concern is tire Walps uh uh flipping, but actually from Wall Street was north all the way to North Henry, and of course that's where this developments are coming and you've already added in, sir. There is some decel range, turn lanes, uh uh and a light coming that you are putting in as [1:54:20, 1:54:40]: As well. And what you say, Mr. Gardner, is absolutely right. Law this based on the Georgia law, we can't utilize that trafficking in certain schools and road structure, infrastructure like that, is a denial for any project particular like this. And for another little note, uh, even though an entire council can travel through this area, I will tell you that myself and Miss Gantt living out of [1:54:40, 1:55:00]: immediate area. So we see this as well on a daily basis. So understand clearly what the And to clear it up. Most folks don't realize if you drive Walt Stevens Road, Walt Stevens Road has a huge right of way. That was because Walt Stevens, if you drive that road, it actually goes into Clayton County and it forleans itself. [1:55:00, 1:55:20]: Where 138 bends and goes in. The goal was to widen Walt Stevens from that point where the old pharmacy is. I think it was the Walgreens work there on that bend, was to widen it all the way over to Red to Flippin. Um but the issue was the interstate and that cost. And that plan has been sitting on the state. [1:55:20, 1:55:40]: And by the way, I need to make a note there. I've I've closed that portion of the of the um need to close that portion of the public hearing in reference to the the public speaking, public speaking of the every spokes on that assum. And so any other any [1:55:40, 1:55:43]: Any other things that you want to emphasize, sir, before we take a vote here? [1:55:43, 1:55:57]: I'm gonna be brief, but I I was just there were questions about traffic impacts, environmental impacts, and details. The detail came in phase one, right? We spent a year at least on that rezoning. As you guys heard, it went through the DRI process of the Atlanta Regional Commission, Greta. [1:55:58, 1:56:10]: staff, the surrounding counties and cities all got together and all talked about a lot of the things that that are being talked about tonight. Uh and the the improvements that we're required to make on Flippin' Road were [1:56:10, 1:56:16]: part of the approval of the west side. So they're actually in the zoning conditions. We we can't decide, hey, we don't want to put that turn lane in. [1:56:17, 1:56:35]: Because it's a zoning condition. So so these things uh are happening and they will happen. And the good news is they're gonna happen by us. Nobody's gonna be waiting for the state or Henry County to f figure out what to do. These are coming right now. We got an LDP last week. You'll start to see these improvements pretty soon. And I guess the the only other thing uh I wanna mention just kind of remind everybody of i I mean [1:56:36, 1:56:56]: Again, a lot of the things that were raised just are not on the table tonight, right? This is not a rezoning. You know, the the the the factors that you go through according to the the code address some of the details that were mentioned earlier, but that we're we're past that, right? We were approved for a hundred unit townhome development in Henry County. We were brought into the city. We're happy to be here, by the way. We're ra would rather be here than Henry County. [1:56:56, 1:57:16]: County. Uh but we're just trying to, you know, we we submitted a plan and the question is, are you guys okay with this plan? That's really the question. And I haven't heard anybody complain about the layout of our design or any of that kind of stuff. So that that's really the question on the table tonight. All right. And originally Ryan had mentioned, Sanson had mentioned the conditions uh that you agreed upon, but I think in your presentation, [1:57:16, 1:57:23]: There are some additional uh conditions that need to be added in to make sure we capture everything, is that correct? [1:57:23, 1:57:24]: Yeah, so so [1:57:25, 1:57:35]: The only thing that that I suggested was uh Councilman Alexander had asked about making the overhangs on the buildings metal. So the [1:57:36, 1:57:56]: The overhang over the door, the overhang on the porch, that kind of things have a metal roof and we're we're we're willing to do that. So that's not in the conditions now. If you guys want us to do that, I'd suggest that. Correct. [1:57:56, 1:57:58]: Okay, so we need to make sure we get those in. So that we [1:57:59, 1:58:08]: He Gordon. What he's got he's got him? Well, he needs to come to the mic then. What's I'm sorry, m Miss um uh uh Gordon needs to come to the mic. Go ahead, ma'am. [1:58:14, 1:58:15]: Yes. [1:58:19, 1:58:30]: Yeah. Right. We got a couple more. The ten foot multi-use path along the frontage of um highway of uh flipping road, uh the flock cameras. [1:58:34, 1:58:39]: And the eighteen in the eighteen hundred minimum square feet uh on the [1:58:40, 1:58:48]: on the m uh with an administrative waiver uh for that particular side. And then the one thing that I saw in the um [1:58:49, 1:59:09]: depiction that councilwoman Gann also talks about and we got caught up in it is that the side of the town homes were brick. Not not all of you had the brick front, but the sides on the end camp of you have four in a row or five in a row that the side of those uh units would be brick on the side. Not [1:59:09, 1:59:23]: Not just hardy plank on the side that um the four in a row you would have the composition of brick stone or stuck over there and but the side on the four or five that you would have in a row would be uh brick. [1:59:24, 1:59:39]: Brick veneer what one which are wondering but then we're gonna need to show us on the you need to look on the presentation. On the depiction it was showed as brick, right? Right. Uh so at basically the ends in buildings that are visible. So you come pull in, you see a end of a town home. [1:59:40, 1:59:47]: And it that would have a th i it would be brick on the side and then the front compared to if you had like [1:59:47, 1:59:55]: Um and then the rest of them in between you can't really see that. Right. But if you if you you know, when you're coming coming into an entrance [1:59:56, 2:00:03]: Or exit way or the end of talking about that, Councilmember Gat? Yeah. Right. That's that's is that brick? Yeah. [2:00:04, 2:00:24]: That's brick, right? It's showing a brick, but our condition right now set forth from material material perspective. I don't have the exact percentage up, but there's a specific material requirement that we must abide by. I understand the intent of the desire for brick and and I would like to commit to that. However, from a constructibility perspective, [2:00:24, 2:00:43]: you could see here that some of these um might have a different transition and material type. No, no, we're aware of it when you wrap it around. So if you had like hardy plank at the front and then you just did brick on the side, it would it would not work with water. I'm getting too deep detailed. Yeah. So my my point is is um [2:00:44, 2:00:45]: Uh I [2:00:46, 2:01:06]: She's only talking about the ones that are visible from the street. Like when you're pulling off of a flippin' road and you see the end cap there, the one on the end cap would be brick'cause it would be visible from Flippin' Road and from Fairhaven or the pulling street. Not all of them. Just the ones that are in the public. We understand the mix of the percentage of the material. [2:01:06, 2:01:13]: Even on the front end, I understand that. But that side like because you're having the majority of the percentage, the majority [2:01:13, 2:01:18]: um based off of our code requires brick majority brick, right? And you do have [2:01:18, 2:01:27]: The option for stone and different other materials, however, on those sides, those end caps, those yeah, that's what we're talking about. [2:01:27, 2:01:36]: Um I sure and and for the record, I just want our audience to know what's going on. I don't I think there's a misunderstanding. [2:01:37, 2:01:41]: We can't vote not to have this project. This is not a zoning. [2:01:41, 2:01:45]: hearing. This is not a zoning saying, hey [2:01:45, 2:02:02]: Um whether or not we're gonna change our zoning to allow for town homes to come to take place. That's not what's happening here. That has already taken place. That took place in Henry County. It was already adopted. We cannot what we're uh working on right now is [2:02:02, 2:02:13]: what those what those what that looks like. So I just want you guys to know we can't vote it against a development that was already in place. [2:02:13, 2:02:18]: We're not voting in regards again, we're not voting on the zoning, changing from [2:02:18, 2:02:22]: Um commercial to residential or commercial to town homes. That's not what we're doing. [2:02:23, 2:02:27]: That was already in place. We can't do anything about it. [2:02:28, 2:02:30]: I just need everybody to understand that. [2:02:30, 2:02:35]: No you are that's not enough. Go ahead, please, sir. [2:02:36, 2:02:36]: Okay. [2:02:39, 2:02:57]: Who is that? I was just gonna have it we're we're okay with what you guys are saying about the brick. I was gonna propose sort of the way to do this. If if we add to building facades, you know, you can keep the language that just that's there, but say you know the the end caps visible from the right of way shall be brick or something you know, something along on that along that line. [2:02:57, 2:03:04]: Okay. Yeah. But I think I do want to make a distinction between what you can see from the road and what may be on the backside. Correct. [2:03:04, 2:03:06]: Ms. Barber, you need a comment, please? [2:03:09, 2:03:18]: Okay, this item is just for council's of approval of those three or is it four parcels? Is that what it is? [2:03:19, 2:03:25]: Is that what we're doing? It's three. Okay. Because [2:03:26, 2:03:32]: You didn't hear me? Didn't hear your comment. My question was for this particular item. [2:03:35, 2:03:53]: They're asking for council's consideration to approve the rezoning for those three particular parcels. Is that what we're doing? No ma'am. Uh so that's what the item says on the agenda. Well that's I didn't write that. So that that's not what we asked for. That may be the way it was described in the agenda, but [2:03:53, 2:04:02]: To to build this development, if I knew let's say this property were zoned agricultural. If I wanted to come in and build what I was going to build, I would ask you for a PUD zoning. [2:04:03, 2:04:11]: I already have that because you guys, when you annex this property into the city of Stockbridge, assign the PUZ district district to it. So we have the rezoning. [2:04:12, 2:04:21]: We would not need to be here at all, but for one wrinkle in your code, which is in the PUD zoning district, you've got to approve a master plan. Basically [2:04:21, 2:04:26]: Here's what you're gonna build, because otherwise we could come and just build whatever we wanted to, right? So this is just to show you look. [2:04:27, 2:04:47]: We got 94 townhomes. Here's how we're gonna lay them out. Here's how they're gonna orient to the properties to the east, here where the sidewalks are gonna go, and that kind of thing. So that's why we're here. We have the zoning we need. We can build townhomes, we can build 94 of them. Uh we just but but to get a permit, we gotta have a master plan, and that's what we're here for. And what and that's what we've been talking about tonight. This is these are not. [2:04:47, 2:04:49]: [7490.0, 7501.8]: The drawing in front of you is what we're proposing. Okay. Well what I'd like to ask for is for you to reduce the density. That's what I like to see. But since you already have gone through that process, um [2:05:02, 2:05:13]: We w we have reduced the decline. I'm deeply confused about where we are at this point. So I would even waste your time. I'm just gonna abstain on this. You seem to have the support from the rest of the council. [2:05:13, 2:05:33]: Thank you, sir. All right. So let's say make sure we got all those additional additional conditions that you agreed to besides what Mr. Anderson had mentioned. So stand by. Um Miss Clerk. Okay. Okay. What additional conditions do you have? I'm going to be agreement with you, Mayor. What I'm showing is the overhangs would be milled. [2:05:33, 2:05:35]: [7535.7, 7545.8]: hundred minimum square feet, ten percent rental cap, ten foot paths along the property to um Reeves Creek Trail. [2:05:46, 2:05:50]: Block cameras and the inn buildings would be brick on the side. [2:05:50, 2:05:51]: And uh [2:05:52, 2:05:55]: Front if they're visible from the [2:05:56, 2:05:57]: And street lights. [2:05:58, 2:06:15]: Well the side we were we talking about the fronts too, visible from the right or I thought we were talking about this in caps. Right. You want street lights, what type of street lights are you talking about, sir? Those well those were the well the the custom the decorative street lights along the front. [2:06:15, 2:06:17]: Deglus three lights. [2:06:17, 2:06:29]: Now the qu that that she added that to List. That will be along the path or wherever the path is, the street lights will be along the because there's no street lights over there now. So that's in addition to staff conditions. [2:06:29, 2:06:39]: Yes. Right, right. Now now the question is, are you willing to all these additional type of taskings or conditions that were added, are you all right with all those conditions? [2:06:39, 2:06:50]: Yes, with one clarification. I thought we were talking about was the end caps visible from the right of way shall be all brick. If that's what you just said, then that's we that's I think thought that's what we were talking about. We agree to that. Yes. [2:06:51, 2:06:57]: That is correct, Council. Is that is that correct? That is correct. That is correct, sir. Okay. So we just add a street like [2:06:57, 2:06:57]: Fleck. [2:06:58, 2:07:00]: Flock cameras and street lights you're good with as well. [2:07:01, 2:07:04]: We we agree, yep. All right. So we've got a yes sir. In closing. [2:07:05, 2:07:15]: In closing? Yes, I have a comment. Okay. Well you you you want before the vote or after the vote? Before the vote. Go right here, sir. Well I I just want to thank you again for the presentation. [2:07:15, 2:07:19]: But more importantly, I wanna thank you for clarifying [2:07:20, 2:07:22]: The test at hand tonight. [2:07:22, 2:07:25]: And I want to make sure that folk that are watching. [2:07:25, 2:07:27]: And the folk that are here. [2:07:27, 2:07:33]: to understand that I think Mrs. Gantt sort of emphasized that too. And you came back and emphasized that. [2:07:33, 2:07:40]: So we just want to make it clear, you know, the task at hand tonight. And I just want to thank you for clarifying that. [2:07:41, 2:07:58]: Yes, ma'am. Go ahead please. And one last thing, and I don't know how we can correct this, but item number ten is confusing. It does say rezoning case. So uh it does confuse the audience. It would confuse me, it would confuse anyone, because although it's [2:07:59, 2:08:19]: Uh uh it it will be confusing in thinking that we are voting to rezone something and we're not. Like that's a staff. Okay. All right, so Miss Barney, you can address the Yeah, so very quickly moving forward, I think Ryan and I just uh spoke about this and by that term I think it already gone out, but it should be approval of a master. [2:08:19, 2:08:22]: of a master concept plan versus a rezoning to a rezoning. [2:08:23, 2:08:25]: No, it's a totally different process. [2:08:25, 2:08:27]: Correct. So the motion needs to say that then. [2:08:28, 2:08:48]: Right. But I I also want the agenda to reflect that. And that and that's important. Um, because people will think that we actually did some type of rezoning and we didn't. It was already here. I don't want to not be transparent to the constituents. I believe that we need to maybe I can randomly make a motion. [2:08:48, 2:08:54]: to amend the agenda to read item number 10 as uh modify I mean um [2:08:55, 2:09:00]: uh you know, changing a plan master plan to a I mean changing a [2:09:00, 2:09:09]: Um a plan unit development into a master plan development. I would like to make that motion prior to us making the motion in regards to this hearing. [2:09:09, 2:09:19]: Because I wanna make sure that it's clear that the audience that our constituents because that was their they came up and a lot of people came up and made public comments that weren't [2:09:20, 2:09:34]: We app although I appreciate it, there's nothing we can do by law that are not relevant to what we were actually here to vote on tonight, which is just changing a plan unit development over to approving it as a master plan. [2:09:35, 2:09:42]: And therefore, we want the record to reflect that as well. All right, so that goes into the minutes. So I would like to make a motion to amend. [2:09:43, 2:09:49]: the agenda to change item number ten on the public under public hearing to read [2:09:49, 2:09:55]: to d take out the words rezoning case and change that to a [2:09:55, 2:09:58]: Change of plan unit development. [2:09:58, 2:10:03]: and to in into a plan unit development master plan. [2:10:04, 2:10:04]: I circuit. [2:10:05, 2:10:14]: All right. That's correct verbiage that you need, uh, Mr. Anderson? Yes, sir. Okay, is there is been made motion made in the second. All favor, please indicate. [2:10:15, 2:10:16]: Okay. [2:10:16, 2:10:24]: Um Miss Barber? I will abstain. All right. So three zero one that passes. Okay. Now that we've done that, and matter of fact, Mr. [2:10:25, 2:10:25]: Mr. Washington. [2:10:26, 2:10:27]: That question. [2:10:27, 2:10:28]: Question. Okay. [2:10:28, 2:10:40]: We can d no no no that's no that's no no that was just for send the the title for the uh title for the agenda item. Now it comes to the vote for the actual approval or disapproval. [2:10:40, 2:10:47]: Okay, that's that w that's where the conditions come in. Yes. Mr. Quentin, what we just did is proper, right? From a legal standpoint? Okay, got it, good. Now [2:10:48, 2:10:57]: Okay. Now council need a motion to approve or disapprove this uh this new concept for this master plan with with conditions. So moved. [2:11:00, 2:11:08]: All right. Uh mister Mr Thomas says to so moves there a second. Before let's let me get clarity on the city clerk. [2:11:09, 2:11:10]: Okay. [2:11:10, 2:11:12]: So you're making a motion then, sir. Yeah. [2:11:15, 2:11:35]: Yeah, I mean the the changing of the verbiage for the agenda item itself. I was the very first one. Okay. But now we now it's the motion you made, sir, in reference to the overall item for approval, disapproval. And you move it for approval. For the mass plan. You handed the approval. For the mass plan. Yes. Mr. Alexander is second. All favor, please indicate. With condition. [2:11:34, 2:11:43]: With yeah, with conditions. With conditions, absolutely, with conditions. You second that, right? Ms. Okay, all in favor please syndicate once again. Three, Miss Barber, you're staining. [2:11:44, 2:11:49]: I will abstain. All right. Three zero one motion passed. Congratulations. No problem.
