[0:17:16, 0:17:20]: Um so with that information stated, um let's [0:17:21, 0:17:35]: If you look at the first page, um the cases start with Keith Nation and it has our approval date of June 23, June 12th, 2023. [0:22:43, 0:22:58]: Henry County to allow for the construction of a mixed residential development which contains both single family detached homes and townhomes. The property is located in Land Lot 35 in District 7 and it contains 48.59 more or less total acres. [0:23:05, 0:23:18]: Thank you, Mr. Chair. The first case before us is an annexation AS dash twenty twenty-four-zero two for properties at seventeen seventy-eight and eighteen seventy-two. [0:23:20, 0:23:28]: The properties in question consist of parcels number zero eight nine dash zero one zero zero [0:23:28, 0:23:33]: one zero zero three that consists of seventeen seventy eight highway forty two north [0:23:34, 0:23:44]: And eighteen seventy-two, Highway 42 North consists of parcel number 089-0100-1000. [0:23:44, 0:24:04]: The properties in question has a total of 48.17 acres. Meritage Homes is seeking to annex these two properties into the city of Stockbridge from the unincorporated Henry County. The parcels again consist of the total acres of 48.17, 48.17. [0:24:04, 0:24:11]: Um the property is located along the eastern side of Highway Forty Two and Campground Road. [0:24:11, 0:24:31]: The annexation is consistent with the city's plan and will not have any negative FET or undue burden on the city's resources. The annexation will also be beneficial to the city because it is adding growth revenue and more commercial services to the city of Stockbridge. [0:24:31, 0:24:43]: The two parcels are contiguous with the city's limitations or limits of Stockbridge staff used. We use the one hundred percent method for the per proposed annexation. [0:24:48, 0:24:55]: As far as the properties description um that was conveyed or as you can see in your staff report. [0:24:56, 0:25:16]: I do would like to uh announce that one 1.5 acres of the floodplain, of the property is located in the floodplain, that it is the northern parcel of this development. Um, as far as the analysis that staff reviewed to determine our recommendation for this annexation. [0:25:16, 0:25:33]: You can find that on your page 10 of the staff report. So the first consists of the property as contiguous with the existing corporate limits with at least one eighth of the aggregate external boundaries. [0:25:33, 0:25:53]: Um as I stated that yes, um one hundred percent they meet the method of the annexation requirements. Um other analysis will be found on page eleven and twelve. Um different questions or analysis that staff will have to review to come to the conclusion of our [0:25:53, 0:26:13]: recommendation. Um it does it is consistent with the comprehensive plan. Um we are taking the property or annexing the property from Henry County um to the city limits. And with these analyses that staff reviewed, we have come to the conclusion that we do [0:26:13, 0:26:20]: to approve um the seeking of annexation within the city of Stockbridge. [0:26:22, 0:26:23]: Thank you, Ms. Jackson. [0:26:26, 0:26:28]: Are there any questions from the board for staff? [0:26:29, 0:26:35]: I I have a question. Have have we done any Mr. Chair, may I you may speak. [0:26:36, 0:26:40]: Uh have we done any studies as far as traffic um [0:26:41, 0:26:42]: In that general area. [0:26:43, 0:26:45]: And uh have we done any studies with the community? [0:26:46, 0:26:46]: And that [0:26:47, 0:26:48]: Area also. [0:26:48, 0:26:49]: has the [0:26:50, 0:26:52]: individual property owners. [0:26:52, 0:26:53]: Establish any [0:26:54, 0:26:57]: uh relationship with the community in that area. [0:27:01, 0:27:11]: So per my knowledge, there were no traffic study reports submitted to staff. Um, I think that question is better suited for the applicant to address. [0:27:15, 0:27:17]: Are there any other questions from board members? [0:27:20, 0:27:24]: Is the applicant present? Would you like this opportunity to speak? [0:27:35, 0:27:36]: I'll accept this one. [0:27:37, 0:27:47]: Can I ask a a question real quick before we start? Got some handouts of the presentation. Are you guys able to see the presentation in front of you as well? Or would you guys want a a hard copy? [0:27:49, 0:27:50]: We can take a hard copy, you can give it to the [0:27:51, 0:27:53]: Thank you for those. [0:27:53, 0:28:13]: And then we do do we uh those are just extra. And then do we do the the all three, like the speed the kind of going over all three at at once? So we just read them in the record. So right now you can just talk about the annexation. Okay. And then you have the opportunity for the other two as well. Oh okay, okay. Uh Kenneth Wood 350 Research Court, Peace Tree Corners, George. [0:28:13, 0:28:33]: Georgia. So we're excited to come before you tonight to talk about this. It's it's been kind of a long time coming. We've looked at the parcel uh that's in question uh for for quite a while, talking about what was the what is the best way to develop it, um, what makes the most sense. Um there was a lot of studies done with the reroute of campground. [0:28:33, 0:28:40]: uh about the best way to have turn lanes and everything on to 42, 42 obviously going out to the highway. [0:28:40, 0:28:50]: And so we started by actually looking at the land use maps that you guys see on your screen, uh the existing zoning, how there was a lot of um PUDs within the area. [0:28:51, 0:28:53]: Uh and then how how to best start it off and so [0:28:54, 0:29:05]: Uh months ago, we actually started with an all-residential plan. And as we start first started looking at it, we had kind of a mixture of just townhomes and then one style of single family. [0:29:05, 0:29:25]: And as we actually were able to talk with uh Councilman Alexander and uh Mayor Ford about the area and what were some of the needs, uh we started talking about more of a mixed use and more about commercial and being able to have re restaurants, retail, uh a potential grocery site. Um he kind of described it as a kind of a food desert for a neighborhood. [0:29:25, 0:29:45]: You know, you got out near the interstate some larger ones, but something as more of a mid-size and being able to set that in place at such a prominent intersection. And so the way it's set up, it actually set up really well for the plan that we have. And I'll be able to walk you guys through that. Uh oh, what did I do? Um, which way am I spending? [0:29:45, 0:29:46]: Mr. Clayton. [0:29:47, 0:29:52]: Do I do the arrows to the right and left? Would you like to see those light player or [0:29:52, 0:29:57]: Yeah, I just wanna be able to click through the art the presentation with the presentation. So you want [0:29:58, 0:30:01]: Are we able to pull up the one we have? Yeah. [0:30:03, 0:30:06]: This is the one he has. [0:30:12, 0:30:13]: That's news. Yeah, that's it. [0:30:16, 0:30:17]: Awesome. [0:30:18, 0:30:36]: And just go oh scroll down. Okay. This is the site location you can see. It's on two sides of campground. Um surrounding it mostly uh raw land and then you have obviously forty two on the frontage, and then you have old campground on the bottom of it, and then there's a a small amount of a cemetery. [0:30:36, 0:30:56]: This is where you can see the proposing of the PUD and where it lines up with a lot of the PUDs across the street. Uh in Henry County, the reason we're having to do the future land use map amendment is in Henry County it's actually listed as high density residential. And so when we're looking at the PUD that we are proposing with the mixed use, uh the density is lower. [0:30:56, 0:31:16]: And so it would be medium density. And so that's why the actual land use change that would be adopted as part of it, because it doesn't hit that high density criteria. This would be added to the part of parkway mixed use overlay. And so just to kind of help understand, it would be a PUD zoning that would fall within parkway. [0:31:16, 0:31:20]: [1880.8, 1883.1]: If you kinda see this is our our plan. [0:31:23, 0:31:33]: Like I said, we had an original plan that had both section of these as residential. And then through a a lot of work in the last several months, uh we came out with a plan you see before you. [0:31:34, 0:31:36]: And so this area right through here. [0:31:36, 0:31:40]: This is uh forty two and then this is campground. [0:31:41, 0:31:58]: And so when you come up, we basically situated the retail restaurant buildings up on the front to hide the parking. We have them kind of all around through here with a little open space here. This is a proposed uh kind of like a local grocery uh that we're sitting in this location. [0:31:58, 0:32:01]: We have a full access and kind of a through road here. [0:32:01, 0:32:02]: Um [0:32:02, 0:32:22]: As part of our our traffic in terms of talking with uh the traffic engineer, we need full left full turn lanes and D cell lanes as part of this. And so they would have left turn lanes as well as D cell lanes into both of the full access entrances uh on campground as well as 42. And then we'd have D cell lanes, this access point here and here. [0:32:22, 0:32:42]: Here are limited, meaning uh you can only go right in or right out. But it gives another access point for the commercial and then limits access into the residential. So you don't have residential just pouring out in a lot of different places. We actually ended up changing the residential in a couple of ways. So all [0:32:42, 0:33:02]: The residential on the north part, since it abuts a few residential houses and then mostly open space land, we left that all single family detached. And then on the east side, that would be a small office. It could be like a dental office, uh, some type of a smaller doctor's office, a salon, any anything like that. Uh, it would be conditioned. [0:33:02, 0:33:22]: As we would be accepted to all neighborhood uses. And that's the same for this commercial that's here. We're very much acceptable to having it as neighborhood uses. You know, no, you know, pawn shops, no any type of outside, you know, car wash, anything like the the items that we've [0:33:22, 0:33:42]: Talked about with the council members that we're not wanting to see there. Automotive repair shops, anything like that. For the residential, it's a three-part mix now. As I mentioned, it's all single-family detached on the top. When you go to the inside, these are the attached homes, but we made them wider. There was a comment made about [0:33:42, 0:34:02]: Wanting to see some wider townhomes. So these townhomes are actually 26 feet wide, which is some of the wider ones that you'll see. And then up here on the frontage, these are rear loaded, meaning if you're driving down 42, you'll see the front of the house. So they're accessed from behind for the garage. But these are detached, what are called bungalows. [0:34:02, 0:34:16]: Then these are single family detached. We have a large amenity area with a cabana, a pool. We're looking at potentially pickleball courts and a dog park as part of our amenity area and package. And one thing to note is we had talked about [0:34:16, 0:34:20]: something similar that we mentioned to the to the councilman and uh [0:34:21, 0:34:41]: Uh Meritage Homes, who's with me tonight, Daniel, uh they built uh Willow Crest, which is over near Floyd Road in Mapleton. And all these product types, the wider townhomes, the bungalows that front on Floyd and Glore, uh, you can actually see those out there at that location. That's been one of the most successful projects in uh the city of Mableton, County. [0:34:41, 0:34:43]: Cobb County uh in that area. [0:34:43, 0:35:03]: As you're looking forward on the site, these are kind of our statistics. Uh, we are originally, like I said, doubled the amount of homes. We cut that down. And so you now you have um 86 uh single family detached homes, and then you have 82 town homes. So you have more single family detached than you do town homes, and then we have uh most [0:35:03, 0:35:23]: Everything is office and commercial retail and restaurant. The square footage kind of gets pumped up because of the potential grocery. It may not end up being that large. Some of them are roughly around 20 to 25,000 square feet. And then the individual pads are five to ten, depending on the restaurant or the restaurant size or the individual. [0:35:23, 0:35:32]: Individual retail, but it has a maximum of 80,000 that could be there. And these are kind of the road alignments and how it loops through this area. [0:35:33, 0:35:46]: These are some pictures of the homes. You have the bungalows in the bottom. Um, here, this is a single family detached. These are town homes. Uh, these are ranch homes that you would have, single story as well as multi-story homes. [0:35:47, 0:36:07]: And these are the three items. I know we're on the annexation case that we were looking at. But as we went through the project and looking at some of the different needs, you know, what really caught us was in in terms of talking with um councilman and the mayor was the was this need for having something. [0:36:07, 0:36:27]: Set in the neighborhood and not only on the interstate that would actually have some retail restaurant and uh potential grocery needs for there, as well as a small place for a potential office at this location when you're looking at it from there. Uh, in terms of the homes, like I mentioned about the townhomes, wanting them to see wider, um, what that limit. [0:36:27, 0:36:45]: lended us to was that lended us to a range to where the townhomes can go up to twenty one over twenty one hundred square feet, the bungalows can go over twenty four hundred square feet and the detached, you know, or twenty twenty up to twenty three, then with basements, they would go up and over three thousand square feet. Um [0:36:45, 0:37:00]: As I mentioned about our amenities, uh the other thing that we are required and we show on our plans is on Highway 42 as well as campground, we're both building the 10 foot multi-use trail that's part of y'all's future trails project to tie in with that. [0:37:00, 0:37:11]: And uh with that, I can take any questions you guys may have and let me know. Thank you. Thank you. Reserve any time. Thank you. I'll now open the uh floor for questions from the board. [0:37:16, 0:37:32]: Right here, none. I will now open the public hearing for the annexation case AX dash twenty twenty four dash O two. Is there anyone who would like to speak in favor or ask any questions or make any comments of this annexation case? [0:37:35, 0:37:37]: Speak in favor. [0:37:38, 0:37:39]: Uh what what is it? [0:37:41, 0:37:48]: Do I from the board, you mean No no no. This is for um the community, so public comments and then we'll come back to the board. [0:37:50, 0:37:52]: All right. Are there anyone yes. [0:37:54, 0:37:55]: Yes. [0:37:56, 0:38:04]: Anyone uh against the annexation case, please come forward at this time. State your name and address. [0:38:11, 0:38:31]: My name is Kyrisha Johnson. I live at 149 Crown Walk in McDonough, Georgia. Um, I'm not necessarily against it. I'm just trying to get some clarity of what's going on with my neighborhood, which is a little north of uh the proposed project. It's right there in the gray. Um we're talking [0:38:31, 0:38:51]: Talking like north east. I'm in one of those uh eight houses on my map that was mailed to me. Um and it's showing that I'm in a yellow block. It's not X off, so I'm not understanding if one [0:38:51, 0:39:01]: of these eight in along Crown Walk are like proposed to be annexed into Stockbridge. I'm just trying to get clarity on that. [0:39:04, 0:39:19]: I'll I'll open it up to staff to answer the question or uh and I could just let you know specifically the parts in the gray are not the actual properties we're talking about. It's solely those two annexation parcels right here. So the ones that are highlighted specifically are the parcels we're discussing. [0:39:20, 0:39:22]: Correct. I gotcha. Um [0:39:24, 0:39:29]: I guess uh I maybe I would need to speak with them, I'm not sure. [0:39:29, 0:39:32]: Your property won't be affected. Probably won't. [0:39:33, 0:39:35]: You don't think we would be annexed into the city of Stockbridge? [0:39:39, 0:39:40]: Okay. [0:39:41, 0:39:42]: Well that's it for me. [0:39:42, 0:39:43]: Thank you. [0:39:45, 0:39:47]: Will the next person come up and please state your name and address? [0:39:52, 0:40:12]: Uh good evening. My name is Jocelyn Williams, one ninety Bank Strive, Stockbridge, Georgia, three hundred two eight one. Uh my opposition is um I haven't had a chance to I think it's gonna be now 168 homes that will be um in consideration on the property. I think they said eighty-six single and eighty-two [0:40:12, 0:40:32]: I didn't get a chance to read like when I normally come, I can see it's gonna be 86 single, just like they said, so I can read. That's why I know it's 168. Um in addition to um the office and retail space. Uh wanted more information so I could. [0:40:32, 0:40:52]: See to take to the neighbors traffic study, the drainage sewage study, specific requirements and ordinance for this property, and um the annexation as it relates to the comprehensive plan. So I wanted more information either for it to be postponed or so I can get more information. Once again, I'm just [0:40:52, 0:41:05]: just writing down what they said twenty one hundred square feet, twenty four hundred square feet, and I think it was three thousand. So I didn't know what the number of homes were until I came this evening. And thank you. [0:41:06, 0:41:09]: Thank you. The next person please state your name and address. [0:41:13, 0:41:23]: My name hello, my name is Courtney Hunter. I live at 164 Titan Road, Stockbridge, Georgia. And I'm coming to just either ask for this to be postponed or actually no. [0:41:24, 0:41:34]: And I'm basing this on information that I have in regards to the builder itself. They have pending like lawsuits dating back to twenty twenty four. [0:41:34, 0:41:36]: Um from shoddy work. [0:41:37, 0:41:41]: from doing you know um actually not using good [0:41:41, 0:41:44]: I think building properties actually building [0:41:45, 0:41:52]: for their homes, they're hiring unqualified contractors, workers, um, they're doing low quality workmanship. [0:41:52, 0:42:00]: Um, they do have homeowners now that are complaining and actually filing lawsuits. Um, in terms of the building of their homes has not been good. [0:42:01, 0:42:02]: They have cracks in their floors. [0:42:03, 0:42:08]: Um cracks going up the walls, actually toilet stools that have not been in pro properly installed. [0:42:08, 0:42:10]: Which is causing water leaks. [0:42:10, 0:42:11]: in their homes. [0:42:11, 0:42:13]: So I'm asking that the builder at least [0:42:14, 0:42:15]: provide information [0:42:16, 0:42:31]: to you all to say, okay, how are we handling these lawsuits and have they actually been resolved? Because that's important, because if you want quality homes in Stockbridge, you do not want to deal with a builder that is not actually coming up to par in terms of building quality homes. Thank you. [0:42:32, 0:42:32]: Thank you. [0:42:33, 0:42:35]: Does anyone else wish to speak about this case? [0:42:42, 0:42:47]: I was emailed a comment from a homeowner if I could read it t into the record. [0:42:51, 0:43:07]: It states, hello, Council members. I hope all is well. My intent to writing this letter is to ask that you postpone the proposal for Meritage Homes to build residential and commercial development on this property. Meritage Homes has a Yelp. [0:43:08, 0:43:22]: Review of one point three. These are real reviews from existing and previous customers. The main complaints stem from the quality of materials used with when Merit Titch Homes bills. [0:43:22, 0:43:32]: and the longevity of those bills. For example, the single family homes on campground built by Meritage Homes have a host of issues. [0:43:32, 0:43:52]: Even when applying for their application to build in Stockbridge, Meritage Homes filed for a variance with the City of Stockbridge to use cheaper materials to build the homes. It is in Stockbridge ordinance that homes should be of three to four sided brick. This variance filed by Meritage Homes was approved by City Council members. [0:43:52, 0:43:53]: Yeah. [0:43:53, 0:43:55]: Mr. Elton Alexander. [0:43:55, 0:43:57]: Along the cheap building materials. [0:43:58, 0:44:18]: Meritage Homes is also responsible for hiring an irresponsible and faulty company to run the HOA of the single family homes. It has been five years since the new single-family homes have been built, and the HOA is already operating in the red because of the management company Meritage. [0:44:18, 0:44:32]: homes put into place. And the list goes on. Highway 42 is expected to be widened in 2030. That's five years from now. That's five years you can ensure traffic flow won't [0:44:33, 0:44:36]: be impacted or disrupted near the space. [0:44:36, 0:44:38]: If this proposal can be postponed. [0:44:39, 0:44:41]: Until the completion of the widening [0:44:41, 0:44:43]: Of Highway Forty Two. [0:44:43, 0:45:03]: Highway 155 is already congested with cars and now an overwhelming amount of 18 wheelers and dump trucks. That's five years for at least one new school to be erected. That's five years to give Costco, Sprouts, Kroger, and all the new and upcoming projects on campus. [0:45:03, 0:45:20]: Ground Road and Jodico Road, the ability to sustain and stay for future growth. With the cost of goods and the cost of living continue to increase, and the new elected president trying to change the demographics of America. [0:45:20, 0:45:26]: which reflects in our communities as well, maybe the growth you expect won't happen at that rate. [0:45:27, 0:45:47]: You intend it to be. Five years give you more time to give a true assessment to which the development is even needed. That's five years for Meritage Homes to improve on their customer relationships and quality of builds. This five-year time span gives the community time to accept and possibly. [0:45:47, 0:46:05]: Understand why this new residential and commercial property may be needed. But as of today, this new construction is not a need of Stockbridge and will only take away more green space, add more frustration to the daily commute that is already evident from Henry County taxpayers. Thank you. [0:46:08, 0:46:12]: Thank you. Ms. Jackson, could you state for the record the name and address of that citizen? [0:46:13, 0:46:18]: An address was not provided. Um the applicant's name is Mr. Turner. [0:46:21, 0:46:29]: Thank you, Ms. Jackson. Those are civil issues and it's outside the scope of the planning commission. So please don't take it into consideration. [0:46:30, 0:46:36]: Thank you. I will now close the public hearing for the annexation case. [0:46:38, 0:46:41]: If there are not any comments from the board, I'll now open it up for a motion. [0:46:43, 0:46:49]: Mr. Chair, we do have conditions placed on the rezoning component of this petition. [0:46:49, 0:46:51]: For the annexation case? [0:46:51, 0:46:52]: Uh just for the rezoning. [0:47:00, 0:47:05]: So uh Miss Jackson, I'm gonna do the vote for the annexation and then we'll go to the comprehensive and then rezoning. [0:47:09, 0:47:12]: So there is there a motion from the board for the annexation case. [0:47:15, 0:47:16]: I might have present it. [0:47:17, 0:47:23]: I'd like to present a motion the uh for the annexation for C P twenty twenty four. [0:47:25, 0:47:25]: Was that an approval? [0:47:26, 0:47:27]: Yes. [0:47:28, 0:47:29]: There's a motion, is there a second? [0:47:31, 0:47:33]: Mr. Chairman, I'll second. [0:47:33, 0:47:42]: Mr. Timidal has motioned. Mr. Minn has second. All those in favor, please signify by the sound of aye. [0:47:42, 0:47:53]: Any opposed? So moved. We'll now move on to the comprehensive plan amendment case. So I'll now pass it back over to you, Ms. Axe. [0:47:57, 0:48:02]: There were no conditions for the comprehensive plan, staff recommends approval. [0:48:04, 0:48:06]: Are there any questions from the board for staff? [0:48:08, 0:48:09]: Uh actually. [0:48:10, 0:48:16]: I actually have a a question uh with regard to the annexation annexation case. [0:48:17, 0:48:30]: I don't know if you can answer this, but is there a reason why sh um certain materials or cheaper materials are being used? [0:48:30, 0:48:31]: To build [0:48:32, 0:48:34]: uh these homes and in [0:48:34, 0:48:44]: That item has already been voted on. It's this can't be discussed further. You would have to ask that question in another case. Okay. So I'll I'll defer you the time. Okay, thanks. During this case. All right. [0:48:46, 0:48:47]: Any other questions for the from the board? [0:48:52, 0:48:57]: All right, would the applicant like to come up for a few minutes moments in regards to the comprehensive case? [0:48:59, 0:49:11]: Sure, as far as the as the comprehensive plan, I the the order always throws you know, I'm trying to make sure I take them in order. So for the comprehensive plan, and then I'll I'll make sure to answer yours. Um [0:49:11, 0:49:24]: It's basically a downzoning. Henry County high density uh coming into the city because of the density. It would be medium density as a mixed use. Um based on some of the comments, I know I didn't rebuttal, but the [0:49:24, 0:49:44]: You know, the idea of that was mentioned about materials, I don't know. Uh Daniel is with Meritage. He could answer probably a little bit more. Uh we're definitely not trying to use low quality materials. Um Willowcrest, the project we're talking about, the one that is uh just finished building out in Mapleton was the one the, you know, as we talked to the councilman and the mayor. [0:49:44, 0:50:04]: that that's what we are striving for. That would be the materials. You can see it, you can you know be able to feel it, see it. Uh that's out there. Like I said, it's on Floyd Road at Galore Road. Um the same product types, everything is out there. Um and uh but we're definitely using high quality materials. You know usually they go off energy star. Probably some of the cheapest materials [0:50:04, 0:50:24]: Material out there would be a vinyl siding. We don't do any vinyl siding. Anything that we do is gonna be uh hardy plank material. It's like uh cementous concrete-based material as well as brick. Um I can't speak to exactly what the complaints were at the previous neighborhood. I'm just uh not prepared with any information on on any kind of [0:50:24, 0:50:33]: Rebuttal there, but um, we definitely would be striving for that type of uh cementous material and uh brick facades as well. [0:50:34, 0:50:54]: Yeah, and and we're fine with um stipulating that we're all we use in all of those superior materials, all the cementitious materials, hardy board, bat, uh concrete, uh shake, uh brick, stone uh materials for the houses. And uh I think we've talked to staff a couple of times that we're fine with that as well as on the commercial. [0:50:54, 0:50:57]: commercial building, making sure they're all uh materials as well. [0:50:59, 0:51:02]: Okay. Are there any questions to the applicant from the board? [0:51:05, 0:51:06]: Thank you so much. [0:51:06, 0:51:14]: Thank you. No, thank you. By the way, we don't have a a variance that allows uh a waiver on uh building materials. That doesn't exist. [0:51:15, 0:51:16]: Thank you. [0:51:19, 0:51:27]: I will now open it up for public hearing for this case. Is there anyone that would like to speak in favor of the comprehensive plan amendment case? [0:51:29, 0:51:32]: Once again, anyone in favor of the comprehensive plan amendment case? [0:51:34, 0:51:38]: Is there anyone against the comprehensive Plan Amendment case and would like to speak? [0:51:44, 0:51:46]: Please come up and say your name and address for us, please. [0:51:50, 0:52:10]: Uh good evening, Jocelyn Williams, one ninety Banks Drive, Stockbridge, Georgia, three oh two eight one. The reason I'm in uh opposition of the comprehensive plan, trying to see and make sure that it's Highway 42 and campground that it's in accordance with what is on the comprehensive plan so I can have more time to evaluate it. Thank you. [0:52:11, 0:52:16]: Yes, ma'am, thank you. Is there anyone else against the comprehensive plan case? [0:52:18, 0:52:25]: All right, if none, I'll now close the public hearing case. The board will now make a vote on the comprehensive plan amendment case. [0:52:27, 0:52:30]: Will I take all right, I'll now accept the motion. [0:52:34, 0:52:45]: Mr. Chairman. Mr. May. I make the motion to approve comprehensive plan amendment case CP twenty twenty-four-zero nine. There's a motion to approve. Is there a second? And Harrow, I'll second it. [0:52:46, 0:52:52]: Mr. Thibodeau second. All those in favor, please use the sound of aye. Aye. All those opposed? [0:52:54, 0:52:56]: All right, so moved, unanimous. [0:52:57, 0:53:06]: The next item on tonight's agenda is the rezoning case, RZ 2024-10. Uh we will now allow for staff to present. [0:53:11, 0:53:12]: Thank you, Mr. Chair. [0:53:15, 0:53:24]: The applicant um definitely gave the board sufficient information as far as staff. [0:53:25, 0:53:44]: The proposed rezoning involves properties of seventeen seventy eight and eighteen seventy two Highway forty two North, also known as parcels eight zero eight nine dash zero one zero zero one zero zero three and also zero eight nine zero one zero zero one zero zero one. Seventy-one of those units are single family, residential, detached homes, fifteen bungalows, and eighty-two townhomes with a density of four point two units per acre. [0:54:13, 0:54:23]: A front yard setback of ten feet, rear yard setback of five feet, and a side yard setback of three feet. The single family detached homes will be [0:54:23, 0:54:26]: At at least five thousand square feet. [0:54:26, 0:54:46]: With a front yard setback of 20 feet, rear yard 20 feet, and side yard 7.5 feet. The amenities the applicant has provided you with the amenities that will be located at this location. Per our records, there will be a pool and a cabana, a mail key. [0:54:46, 0:54:51]: kiosk and nine point seven five acres of open space. [0:54:52, 0:55:12]: The commercial section will have 70,950 square feet of space consisting of six buildings, which may consist of a grocery retail store as well as restaurants. The parking proposed is 336 parking spaces. Staff has recommended. [0:55:12, 0:55:16]: Amend approval with conditions and I'll read those into the record. [0:55:18, 0:55:27]: The first condition is the subject property shall be developed similar to the site plan that was submitted by the applicant on January twenty-first. [0:55:28, 0:55:30]: The bungalow lots [0:55:30, 0:55:35]: Located on lots one through fifteen of the site plan shall be three sided brick. [0:55:37, 0:55:39]: A landscaping plan shall be submitted. [0:55:41, 0:55:48]: Number four, a ten foot external sidewalk and eight foot internal sidewalk shall be installed. [0:55:49, 0:55:55]: Number five, the building facing the street on campground road shall be three sided brick. [0:55:57, 0:56:09]: Number six, the buildings labeled dining patio on the site plan must adhere to the parking standards found in section four point eight of the City of Stockbridge Unified Development Code. [0:56:10, 0:56:22]: Number seven, no more than one hair salon, barber, shop, nail salon shall be in the commercial section. No event centers nor nor gas stations shall be allowed. [0:56:23, 0:56:32]: Number eight, the applicant must combine the two parcels located at seventeen seventy eight and eighteen seventy two Highway 42 North. [0:56:33, 0:56:50]: And I believe we're saying that should be combined prior to receiving the LDP, which is the land disturbance permit. In addition, no permit shall be issued by the city of Stockbridge until the developer provides a copy of the recorded plats. And that concludes the conditions for this properties. [0:56:50, 0:56:53]: Thank you, Ms. Jackson. Are there any questions from the board for staff? [0:56:55, 0:56:58]: Yeah, I have a question. Uh is it gonna be H O E? [0:57:00, 0:57:05]: That is a great question. I believe the applicant will be better suited for that question. [0:57:07, 0:57:07]: Please. [0:57:10, 0:57:30]: Chairman, I'm sorry about that. I meant to ask you permission to speak. Kenneth Wood, 350 Research Court, Beach Street Corners, Georgia. Um so now that we're on to the I I don't know if there's a way to get over to our presentation. Um now that we're on to the to the rezoning part of it. I'll try to answer some of what we've heard as well. [0:57:30, 0:57:50]: uh just to kind of bring it all back in. As I mentioned, this has the conditions of the zoning like we talked about for all the materials, uh what it can and can't be for the retail, for the residential, uh, for the neighborhood use, for the commercial that is to be built, um, and how it's to be built, the external sidewalks that we talked about are all in the staff conditions uh that we looked at. [0:57:50, 0:58:10]: For this. And then what we'll also do is we'll give cards tonight so we can also meet with some of the people that had spoken in the community to be able to bring them up to speed on any questions they may have. And then the one question about the annexation that the land, the project that is just to the existing single family would [0:58:10, 0:58:20]: should not be part of the annexation uh going through as well. Um do I have the ability to get over to do y'all have the site plan within here? Gordon, could you help him get to his presentation? [0:58:22, 0:58:42]: I think uh I can use this question. Yes. Uh Gordon, while he does that. I could use this. This is fine. Like this one. Yeah, that's a cycle. Can y'all see this up here? Okay. This is perfect. This kind of shows you the different components. Uh the bungalows are detached, uh as we mentioned. The single family, uh you you have all the amenities that were [0:58:42, 0:59:02]: Running through there, the sidewalks, all the turn lanes, everything that we're required to do for all the access points coming into the development, coming out of the development that you see there. And really, you know, the big catalyst to this was really creating those neighborhood uses, uh, get pulling away from the interstate and the big box commercial and trying. [0:59:02, 0:59:22]: Trying to have more neighborhood scale retail uses. So, you know, if there's a place to eat, it can be more neighborhood, it can be more local to be able to be found there. Um, that was kind of what we were going for. That's why we wanted to mix the re the really the foot traffic of the residential uh with the foot traffic of the retail here. And that's why we have in the back, you'll kind of see in this. [0:59:22, 0:59:23]: Yeah. [0:59:23, 0:59:43]: You can kind of see this is kind of more of an open space. So you can basically come across and be able to enter into the open space and get to the to the retail, the restaurants, or any of the grocery uses that would that would come in this place. We do have sufficient stormwater management, all the different parts of the site. We have stormwater ponds for all the different phases. [0:59:43, 1:00:03]: That would take care of uh storm water management. Uh we have received a sewer letter from Henry County for water and sewer uh for the area. Um we also have, I believe, water. We're able to tap in. I believe the city of Stockbridge, you get I believe we can get to water. It's just Henry County, I believe, is the sewer uh for this one. But adequate pressures uh [1:00:03, 1:00:23]: for the development for what we're able to do. Um and then you also saw where we also have the basically the larger sidewalk on this access road coming through. So that would put larger sidewalks on campground on forty two as well as traversing through the development, making sure that as in the future as everything get built out and, you know, we're really talking about as we [1:00:23, 1:00:43]: There was a comment about some of the um the five year plan for some of the build outs. I mean, this plan right here is kind of a three to seven year in terms of how long it takes. It just takes so long now. You know, once you start into permitting, actually get something vertical and in the ground. Uh, you know, we were talking about several years from now, uh just going but the first home. [1:00:43, 1:01:03]: And then that three to seven years for a build-out time frame, uh, getting up to speed uh to line up with those different uses. And with that, I can take any questions. And like I said, we really, really just tried to make a really good mixed use development and meeting all all of what we read in the maps about what is desired for the area, uh being able to see it. [1:01:03, 1:01:15]: it making sure like I said it's neighborhood uses and the scale for that. Thank you. Commissioner Tudot, please go with your questions. Thank you. Uh will this property be fee simple? I mean in terms of purchase uh [1:01:16, 1:01:31]: Also, you're not gonna turn this into rental property, are you? No, and I think we're okay with with any rental restrictions.'Cause that's something I didn't hear from staff because uh that's one of the issues that I know people are always concerned about. [1:01:31, 1:01:33]: that developers coming in and [1:01:34, 1:01:54]: Developed property and the next thing you know, it's all rental. And uh we don't want to get caught with that situation. If you're not gonna do that, yeah. Well what we've been seeing, especially with Meritage, there are they are a fee simple. This will be a full HOA. Uh all the covenants, all the documents that you know usually has a rental restriction, something like 10%. And that's just in case someone relocates and has to. [1:01:54, 1:02:03]: To rent their home for a period of time, but it is it, you know, the intent is not to be a rental property. And if it's in the zoning conditions, the HOA can't change that. [1:02:04, 1:02:06]: Thank you. Any other questions from the board? [1:02:08, 1:02:09]: Thank you so much. Thank you. [1:02:10, 1:02:10]: Right. [1:02:12, 1:02:21]: I will now open the public hearing for this case. Is there anyone who would like to speak in favor of the rezoning case? RZ 2024-10. [1:02:25, 1:02:28]: Once again, is there anyone in favor? In favor of this case. [1:02:31, 1:02:33]: Please come forward, say your name and address. [1:02:35, 1:02:43]: Carisha Johnson, 149, Crown Walk, McDonough, Georgia. Um, my question is, uh I heard him say that [1:02:44, 1:02:51]: I guess the timeline of things. Um, you were saying that it would be seven years or three to seven year plan. [1:02:53, 1:03:02]: To build out everything. Okay. So the houses, how how far are we looking out for that? Yeah, how like how soon would the houses be built? I mean [1:03:03, 1:03:10]: Ma'am, please suppose don't address the commission, though you can't speak from the floor. [1:03:10, 1:03:11]: Oh. [1:03:12, 1:03:22]: Oh, ask them. Oh, y you guys know the answers. Okay. My question is, how far out are we expecting um single the the homes to go up? [1:03:22, 1:03:30]: You can so you ask all your questions and then we'll have the applicant or whoever can answer come up. Yeah. Okay, I'm sorry. Didn't I on the protocol? That was it. [1:03:30, 1:03:34]: Thank you. Anyone else in favor? Please say your name and address. [1:03:37, 1:03:38]: Oh [1:03:38, 1:03:46]: R Rodney McKenzie. Um my address is 843-Orwheel Drive and Stockbridge. Um, I am in favor. [1:03:46, 1:04:01]: Uh I do have a question in terms of the applicant as far as they are a residential builder. And my question would be, have they taken on a uh project of this size when you [1:04:02, 1:04:02]: Incorporate [1:04:03, 1:04:05]: Commercial and residential. [1:04:06, 1:04:11]: So that is that would be a question that I would like to know if they've had previous projects that they have been successful. [1:04:11, 1:04:14]: В конструктing residencial. [1:04:15, 1:04:15]: And commercial. [1:04:16, 1:04:18]: Um my nets um [1:04:19, 1:04:35]: in favor is not necessarily a question, but it's more so of um maybe a suggestion or what have you. Um I do know that Meritage Homes has just completed, I guess, the Eagle Hill Town homes and the single family homes that sit right next to those. [1:04:36, 1:04:37]: And so um [1:04:38, 1:04:46]: With the city of Stockbridge, all I'm asking is that um they give residents some type of um [1:04:48, 1:05:00]: uh variety, right? A lot of these builders come in and they tend to, you know, they'll build one community and then they'll move on to another community and it's all still the same style homes. [1:05:00, 1:05:13]: So maybe look at maybe them offering or showing what style uh or not necessarily style, right? But actual floor plans. So we can have something, some type of variety within the city. [1:05:13, 1:05:27]: You know, you just built one community and I'm all for all of this, but then you're gonna build another one. Let's just make sure let's make sure that it's not the same homes that we're seeing all around our city. All right. Thank you. [1:05:27, 1:05:27]: Thank you. [1:05:31, 1:05:39]: Before I bring the applicant back up to possibly answer any questions, is there anyone against the current uh rezoning case? [1:05:44, 1:05:46]: Please come forward to say your name and address for us. [1:05:51, 1:06:11]: Uh good evening. Um Jocelyn Williams, one ninety Banks Drive, Stockbridge, Georgia, three oh two eight one. The reason I'm for uh opposition of the rezoning is due to the infrastructure that's down on forty forty two and camp uh grounds, um and taking a three to seven year um timeline. [1:06:11, 1:06:17]: will um make it very challenging for that area. Thank you so much for your kindness. [1:06:17, 1:06:17]: Thank you. [1:06:22, 1:06:32]: Courtney Hunter, 164, Titan Road, Stockbridge, Georgia. I just have a question. Wanted to know would the City of Stockbridge legal team be researching any the complaints? [1:06:32, 1:06:37]: that is against maritage homes before we make a final decision as to whether or not to proceed [1:06:38, 1:06:39]: with the building of the homes. [1:06:40, 1:06:49]: So I believe that is beyond the power of this planning commission. Uh but what I'll do is I'll defer that question over to staff. Okay. Thank you. Thank you. [1:06:49, 1:06:53]: Uh would the applicant like to come up and answer those two questions from the community? [1:06:57, 1:07:17]: Sure. I am not aware. I will, you know, in between the two hearings, I will try to find out. I'm not aware of any lawsuits that are that are out there. I know Daniel mentioned he wasn't either either. You know, the three to seven kind of the infrastructure the build out is try to give an idea. You know, if you s if you start construction, you know, you're two years roughly, you know, get [1:07:17, 1:07:37]: Getting a permit, actually turning dirt, the ugly part of it, and then building vertical. You know, you're over two years before you just see a first house uh come in the ground. And then you have years of of of build out for that. And that's what it's for. Um as far as as far as the residential mixed use, uh Willowcrest, like [1:07:37, 1:07:57]: We mentioned, you know, has the mixture of uses within it. Um, Meritage is a national builder, so they are used to partnering with landowners. Rowan, the landowners want to partner, uh, finding the tenants that we're talking about. Uh, at one point, Publix was looking at this site and they ended up kind of going a little further. So the idea was to kind of bring that more narrative. [1:07:57, 1:08:12]: neighborhood size. And so that's really gonna be the focus right now as a partnership to focus on those those um more neighborhood style tenants because there's a need. There's the traffic that is there and there's the need uh for that as well as the housing coming in within walking distance. [1:08:12, 1:08:32]: Um, it was a great question about the variety of home. And really, when we talked to uh council member Alexander, that was one of the big reasons that the plan has evolved as staff has seen it from what it was to what it is now. Um originally when we first submitted, we had uh four feet, you know, narrower townhomes. Uh you actually can see it down on one of the the sites. [1:08:32, 1:08:52]: That was that was discussed. The materials that we're talking about, the three-sided, uh, then also the bungalows was something new. Uh, those don't exist in Henry County in terms of that style of a home, of a detached home that exists in Cobb. And we wanted to bring it over here after talking to him, as well as the townhomes being more to [1:08:52, 1:09:12]: Two-story but wider. Then that way when you're looking at it, it feels more like a single family detached home and it lives more like a single family detached home because of that extra width on it. And then the single family detach having uh a minimum width to it, but then on the north side, we have more room that we can spread out, push the setbacks back. Uh one of the other conditions. [1:09:12, 1:09:32]: That we've been talking about with the councilman was actually having so that we're 30 feet from any any curb with the townhome. So you have way sufficient parking for the cars and everything else. And we have that on our on our plan as well. And so we definitely feel like what we've done with the changes that you see before you today, that we do have. [1:09:32, 1:09:36]: a different variety that you will actually see. But it's a it's a great question. [1:09:36, 1:09:56]: Okay, I'm gonna take a quick uh point of personal privilege to ask a few questions. Sure. Um did you tell us the exact amount of parking lot uh spaces per unit? Uh so everything everything has a a two-car garage, has uh the ability to have two parked, but then we also have additional guest parking through the through the [1:09:56, 1:10:08]: the community. So there's four per every house, uh, but then there's also guests like head end parking, the amenity has parking, and then there's parking on the on the roads, little like uh parallels and everything. [1:10:08, 1:10:28]: Perfect. And I know one of my uh board members, fellow boardman, has also talked about the discussion of an HOA. Is that something that you all plan to bring into this development? Absolutely. Um we'll be fine with committing to the rental restriction and the HOA. Okay, I would I would ask staff to add that to um the conditions that we have set for them. [1:10:28, 1:10:43]: Uh and of course it'll come back to a vote upon this committee, but I also want to know in regards to the HOA, uh, how fast or how immediate would they have the opportunity and the authority to basically manage that property and then what would be the percentage of the capacity at which they can manage? [1:10:44, 1:11:04]: Yeah, I know it goes uh there's a new law as related to when HOAs turn over and I wanna say it's in the ninety ninety percentile range. Uh it's it's very high, yeah. So we would a lot of our communities we don't usually turn over till the last house is sold. So somewhere when you're very close to selling out the last house is when you turn over to the [1:11:04, 1:11:24]: Um home owners. When I was doing different zonings and different places, it was around like 60, 70 percent. And the the c the complaints was [1:11:24, 1:11:34]: when the HA was taken over, there were still construction zones and and they were trying to regulate that and it became a became an issue. So th I think that's all changed to a higher percentage now. [1:11:34, 1:11:36]: Okay, perfect. Thank you so much. Thank you. [1:11:36, 1:11:40]: Right. I will now close the public hearing case. [1:11:40, 1:11:45]: I will now accept a motion from the board. [1:11:54, 1:12:01]: I'd like to present a motion for the rezoning case number RZ twenty twenty-four-ten. [1:12:02, 1:12:06]: Thank you. Before I I take a second, Ms. Jackson, you wanted to add something? [1:12:12, 1:12:22]: Mr. Chair, I just want to be clear on the rental cap that you would like for us to add to the condition. That would be condition number nine. [1:12:22, 1:12:27]: Do you have a specific number in mind or could we recommend? [1:12:28, 1:12:35]: A percentage? I would allow the staff to give the best recommendation for it. Code is ten percent. I'm fine with that. [1:12:38, 1:12:40]: Excuse me, Mr. Chair. Yes. [1:12:42, 1:13:02]: I'm not sure if I'm in the ballpark but I I just wanted to I I I'm just um I I just want to ask how much uh or is this affordable housing or the range of, you know, w when these properties start versus you know, how much how much I mean [1:13:02, 1:13:05]: The the minimum to the maximum. [1:13:05, 1:13:10]: I'll allow the applicant briefly. Yeah, you're allowed to briefly come. Mm-hmm. [1:13:14, 1:13:34]: So our internal projections are based on the market as it is today. It's anyone's guess what the market will be in two and a half years when we're selling the houses, but we would sell at whatever the market allows us to sell. Right now, that projection for us is in the mid-threes to high fours. [1:13:34, 1:13:38]: Thank you so much. [1:13:40, 1:13:47]: I have a motion to accept uh with staff conditions from Mr. Thibodeau. Is there a second? [1:13:48, 1:13:51]: Mr. Chairman. Yes. I'll sock on that motion, please. [1:13:52, 1:14:09]: Commissioner Doumas has seconded the motion. All those in favor, please signify by the sound aye. Aye. Any opposed? So moved. The rezoning case has passed. The next item on tonight's agenda is project updates. Ryan is Could you repeat the um motions? [1:14:09, 1:14:18]: Yes, Mr. Thibodeau made the motion to approve with staff conditions. Uh Commissioner Dumas seconded that motion. It was voted unanimous. [1:14:20, 1:14:40]: Are there any project updates from staff? No, we don't have any. Any staff comments? Uh yes, we'll like to welcome Miss Ms. Walker Boyd and thank you for your s your volunteering your service. Uh we'll be scheduling a training for you in the upcoming weeks. So we'll begin the email. We'll be with the ARC. [1:14:39, 1:14:41]: So we'll send you an email shortly. [1:14:42, 1:15:02]: Thank you. Thank you. I'll now pass it over to Commissioner Min for board comments. Thank you, Mr. Chairman. I'd like to thank uh Commissioner Dumas for the last year's leadership. Uh very eloquent, calm demeanor, certainly uh an example of uh well-run meetings. So thank you again. [1:15:02, 1:15:03]: Yeah, sir. [1:15:03, 1:15:13]: Thank you, sir. Any other comments from the board? Uh don't forget, uh very professional, very causal, just a great guy. [1:15:15, 1:15:15]: Thank you. [1:15:17, 1:15:37]: And I I'm thankful that I am able to serve with you guys and for the community. Uh District Five i I do live in District Five, so I know uh very much a lot about District Five. So uh I appreciate uh everybody speaking tonight. [1:15:38, 1:15:55]: Let me say I look forward to serving um as this year's chair. I it was a shock for the motion, but I know I have some big shoes to fill with Commissioner Dumas, so I'm glad he's still on the uh board with us to serve. Um and so let's get ready for an awesome year. The last item on tonight's agenda is adjournment. Do I have a motion from a board member? [1:15:56, 1:15:57]: Тому [1:15:57, 1:16:02]: All right, so boom by mister Doomis. Is there a second? I'll second it, Harold. [1:16:02, 1:16:11]: Got two seconds, so I'll take the second from uh Commissioner Thibodeau. All those in favor, please say aye. Aye. All right. This meeting is adjourned at 747 p.m.
