[0:07:45, 0:07:49]: Is the rezoning case RZ twenty twenty five dash O two? [0:07:50, 0:07:56]: I will read it into record. After that we will have a presentation from staff and a public hearing, and then the board will vote on this case. [0:07:58, 0:08:18]: Rezoning case RZ-2025-02. Property is located in the council district of District Four. Consideration of a city of Stockbridge initiated rezoning request to rezone property at Fort 4482 North Henry Boulevard, parcel number S twenty six dash zero one zero one four thousand. [0:08:17, 0:08:24]: from SR suburban residence and DV Downtown Village Overlay District to PUD master plan. [0:08:25, 0:08:45]: And D V Downtown Village Overlay District for the purpose of allowing the construction of a missed mixed residential development. The City of Stockbridge owns this property and is and is the applicant. The property contains fifteen point three as or minus acres and it is located in landlots 61 and 62 of District 12. [0:08:45, 0:08:47]: [550.0, 551.1]: Here Boulevard? [0:09:12, 0:09:13]: Yeah, service right. [0:09:14, 0:09:20]: Miss Linda. Sorry to interrupt you. Could you do me two favors? Could you make sure the mic is on? [0:09:22, 0:09:28]: And then could you also click present on the PowerPoint? All right. Is that better? All right. And then can you click present on the PowerPoint so we can see it full screen? [0:09:31, 0:09:31]: Uh [0:09:35, 0:09:39]: Yeah, well I'd like to you see the panels at the side. [0:09:40, 0:09:45]: It's just a too hard it's not hard. It's a little hard for us to see it like that. Thank you so much. [0:09:48, 0:09:51]: Full screen is in that. There you go. [0:09:56, 0:10:06]: Okay, so again here's the aerial photo. Um let me start at the beginning. This is a presentation for rezoning case number RZ twenty twenty-five oh two. [0:10:06, 0:10:11]: Properties located forty four eighty two North Henry Boulevard in Stockbridge. [0:10:11, 0:10:15]: Um the property is bounded by North Henry Boulevard to the south. [0:10:16, 0:10:20]: And Sara Sea Drive on the west, which actually dead ends into the property. [0:10:20, 0:10:23]: А блок аве Булвард Ана іст. [0:10:26, 0:10:36]: So this property is owned by City of Stockbridge, parcel number S twenty six O one oh one four thousand. It's got approximately fifteen point four three acres. [0:10:36, 0:10:54]: I mentioned the boundary surrounding streets. Um there are also two small parcels to the south and southeast, which city Stockbridge also owns. City may develop them in the future for commercial, but they are not part of this rezoning request. [0:10:54, 0:11:07]: So right now the property has a base zoning of SR which is suburban residential. It is also located in the downtown village overlay district. And the future land use designation is downtown district. [0:11:08, 0:11:17]: So the purpose of the rezoning is to rezone the property from SR Suburban Residential District and Downtown Village Overlay District to PUD. [0:11:18, 0:11:19]: Planned unit development. [0:11:19, 0:11:21]: uh district master plan. [0:11:21, 0:11:22]: And [0:11:22, 0:11:42]: Downtown Village Overlay District, that part would stay the same. So rezoning is needed because proposed this is a development for proposed single family and townhomes. The townhomes are not allowed in the SR district. So that's why property needs to be rezoned. And also the PUD zoning, which is requested, um [0:11:42, 0:11:46]: requires two types of land uses allows and [0:11:46, 0:11:48]: And requires two types of land uses. [0:11:49, 0:11:52]: Uh D T V district could stay the same as I mentioned. [0:11:53, 0:12:00]: Uh these the proposed town homes would would be compatible with the land use designation of the property of downtown districts, so therefore [0:12:00, 0:12:03]: There is no comprehensive plan. Amendment is needed. [0:12:05, 0:12:07]: Here are maps of the property. [0:12:07, 0:12:11]: The star is the location of the property. On the left, that's the zoning map. [0:12:12, 0:12:15]: You see all the yellow area that is the SR district. [0:12:16, 0:12:20]: And then uh to the right we have the uh downtown village overlay district. [0:12:20, 0:12:23]: Um two colours of purple, but the um [0:12:23, 0:12:26]: The lighter shade is the downtown village overlay district. [0:12:27, 0:12:32]: And property is not, by the way, in the PMU overlay district. [0:12:32, 0:12:33]: Uh [0:12:35, 0:12:40]: Okay, this is just an enlargement of those same zoning some same maps. [0:12:42, 0:12:50]: All right, and here's the land use map. The purple area is the downtown district. That is the that is the future land use designation. [0:12:51, 0:12:58]: This is a survey of the property. It's ki it's kind of light, but the two small parcels down here, those what I said a moment ago. [0:12:58, 0:13:03]: that the city also owns those on C two and city might develop them in the future. [0:13:04, 0:13:10]: Uh here is the proposed master plan. Now I do have an enlargement if you wanna [0:13:10, 0:13:23]: That's pretty large. It's kind of light, but um anyway, main entrance would be from North Henry Boulevard. There would be a second entrance to the to the west. The Sara Sea Drive would be extended into the property. [0:13:24, 0:13:27]: Uh, there would be also several internal streets, a cul-de-sac at the back. [0:13:28, 0:13:31]: Um the townhomes would be units would be [0:13:31, 0:13:32]: In the front [0:13:33, 0:13:36]: And the single family would be at the at the rear. [0:13:37, 0:13:43]: Here is some uh information about the development, mixed residential, so sixty-seven total units. [0:13:44, 0:13:50]: And of those there would be twenty five single family at the rear and forty two townhomes at the front. [0:13:51, 0:13:55]: I mentioned the property accesses. A monument sign would be [0:13:56, 0:13:57]: Erected um [0:13:57, 0:13:59]: At North Henry Boulevard, at the front. [0:14:00, 0:14:02]: The amenities would be too landscaped. [0:14:03, 0:14:05]: Areas with pavilions. [0:14:05, 0:14:09]: Um, we have lot dimensions, single family lots would be fifty feet. [0:14:09, 0:14:11]: Wide and eighty feet deep. [0:14:11, 0:14:31]: And then the townhome lots 24 feet wide and 46 feet deep. So setbacks would be 20 feet or more. Now, PUD zoning, of course, does not have any specific setback requirements, but this is what is proposed. If rezoning is approved, the city, of course, would uh select a developer to [0:14:31, 0:14:34]: Determine further project details. [0:14:35, 0:14:44]: Um now we've reviewed the applicable zoning regulations, uh some things about the PUD district, its intent to provide balanced neighborhoods. [0:14:44, 0:14:49]: property must have three acres at least to qualify for PUD. [0:14:49, 0:14:50]: And also two types of [0:14:51, 0:14:53]: uses or two types of housing. [0:14:53, 0:14:58]: And it requires a master plan, a site plan, which that's what this is. [0:14:58, 0:14:59]: The site plan that I showed you. [0:15:00, 0:15:05]: Uh the downtown village uh overlay district, um its purpose is to [0:15:05, 0:15:10]: augment the downtown area and recognize an affirmative as a central focus. [0:15:10, 0:15:13]: of commercial, artisan civic activities. [0:15:13, 0:15:17]: And allow the existing downtown area to flourish and intensify. [0:15:18, 0:15:19]: Um [0:15:19, 0:15:24]: and other intent is to provide a retail service and civic center for the city. [0:15:25, 0:15:30]: Now very important about the downtown um uh overlay district. [0:15:30, 0:15:45]: is that the these regulations take precedence over regulations of all other districts, including the base zoning district and any other overlay district. Okay, uh single family, multifamily uses are special uses. [0:15:46, 0:15:46]: Um [0:15:47, 0:15:50]: And there are extensive architectural requirements for [0:15:50, 0:15:52]: The townhomes of multifamily. [0:15:53, 0:15:54]: And [0:15:54, 0:15:55]: There's there's a lot of them here. [0:15:56, 0:16:00]: Um, I'll just mention'em. We can discuss it further if you wish. [0:16:00, 0:16:05]: Um this is about exterior facades should be proportionate to surrounding buildings. [0:16:05, 0:16:07]: uh s as well as a scale. [0:16:08, 0:16:11]: Now exterior shall surfaces shall have three sides brick. [0:16:12, 0:16:14]: Of a h three sides with a hundred percent brick. [0:16:15, 0:16:28]: And the front side at fifty percent brick or stuck stone or stucco. Color should be s harmo harmonious with surrounding development. Um you've got to ha enclose a trash uh area, eight foot sidewalk, [0:16:29, 0:16:48]: historic street lamps and minimum fourteen feet um front yard setback may go up to twenty feet. All right, um let's see, side yard setback at least ten feet, uh rear twenty-five, maximum of four stories or fifty-five feet a high. [0:16:48, 0:16:56]: Um off street parking, you gotta have an eight foot buffer um between the facility and streets, islands eight feet wide. [0:16:57, 0:16:57]: And [0:16:58, 0:17:02]: A let's see, separated by every four feet. [0:17:02, 0:17:05]: Separation is four feet in width every twelve spaces. [0:17:06, 0:17:22]: And utilities should be located underground. That I have not seen in other other districts. So that that's something different. All right, so he analyzed according to the UDC what the regulations are. This proposed rezoning would be consistent with the comprehensive plan. [0:17:22, 0:17:24]: Providing additional housing for the city. [0:17:24, 0:17:28]: Um compatible with the future land use destination of downtown. [0:17:29, 0:17:32]: Its near downtown would help to extend it with compatible uses and [0:17:33, 0:17:38]: And it would represent an infield development because the site's been vacant for a long time. [0:17:38, 0:17:53]: Uh let's see. So the rezoning is necessary as I mentioned because town homes are not allowed under SR and would also offer a transition between the adjacent commer and surrounding commercial uses and single family at the rear. [0:17:56, 0:18:06]: Um some of these I've mentioned already. The property itself is relatively flat with no flow flood no floodplains. There is a Georgia Power Company Easement. [0:18:07, 0:18:09]: On the east side, bordering to the east. [0:18:09, 0:18:12]: That would need to be protected and not encroached or anything. [0:18:12, 0:18:24]: uh impacts on adjacent property owners. This is a relatively small development and and at least half of it would still be single family to be compatible with the single family therir. [0:18:25, 0:18:30]: Um, traffic would use North Henry Boulevard or use the traffic light from North Lee Street. [0:18:32, 0:18:46]: Okay. The public works department would provide water and sewage services. Now I contacted them. I'm still waiting to hear back from them as far as to determine uh would there be sufficient um capacity to serve this proposed development. [0:18:47, 0:18:51]: The fire marshal is in favor of the two accesses that are proposed. [0:18:51, 0:18:52]: Um [0:18:52, 0:18:56]: Again, they could use uh left turning vehicles, could use uh the traffic signal. [0:18:57, 0:18:58]: Ah, let's see. [0:18:59, 0:18:59]: And [0:19:00, 0:19:02]: Now could this happen? Um could [0:19:02, 0:19:13]: this property be developed under SR, it it could, but whether it would totally be developed with single family is questionable due to the presence of nearby commercial uses. [0:19:14, 0:19:28]: Okay. Recommendations. Okay. And should I read these into the record? So staff recommends approval with the following suggested conditions. Uh Mr. Chairman, do you want me to read these into the record? [0:19:28, 0:19:29]: Uh yes, please. [0:19:29, 0:19:30]: Okay. [0:19:30, 0:19:31]: Number one. [0:19:31, 0:19:36]: Conceptual site plan conceptual site plan shall serve as the master plan for the proposed development. [0:19:37, 0:19:41]: in terms of the numbers and types of residential uses to be built. [0:19:41, 0:19:49]: Site accesses, overall design of the project, thereby fulfilling the requirement for PUD zoning of the property. Number two. [0:19:50, 0:19:57]: LDP site plan. A more detailed site plan shall be developed once the city secures a developer for the project. [0:19:58, 0:20:14]: And it shall be prepared in accordance with the requirements of the downtown village overlay district to aid in stimulating and preserving downtown Stockbridge, as follows. A, this is two A project size, maximum of seventy residential units shall be constructed. [0:20:14, 0:20:20]: which would represent a density of four point five four point five four units per acre. [0:20:20, 0:20:21]: Uh two B. [0:20:22, 0:20:31]: Setbacks. The building setbacks shall be a minimum of fourteen feet from the curb for front yards, minimum of ten feet on the sides for single family detached homes, [0:20:31, 0:20:35]: and in units of townhomes or other attached residences. [0:20:35, 0:20:37]: And a minimum of twenty five feet for the rears. [0:20:41, 0:20:42]: K two C. [0:20:42, 0:20:44]: Amenities a developer shall consider [0:20:45, 0:20:50]: Adding a dog park, a walking trail, a playground, and or picnic a barbecue area. [0:20:50, 0:20:58]: uh two two D, trash handling, an enclosed dumpster shall be provided rather than individual trash cans. [0:20:58, 0:21:12]: two E internal sidewalks. Internal sidewalks shall be located on both sides of streets and they shall be at least eight feet wide in the front yards of residences, including a six foot wide [0:21:12, 0:21:15]: Sodted landscape buffer between a street and a sidewalk. [0:21:15, 0:21:17]: Two F. [0:21:17, 0:21:18]: Parking spaces. [0:21:18, 0:21:21]: A sufficient number of parking spaces shall be provided for [0:21:21, 0:21:24]: In relation to the number of bedrooms per residential unit. [0:21:25, 0:21:29]: according to the UDC, as well as for common area guest parking. [0:21:29, 0:21:30]: two G [0:21:31, 0:21:32]: Park and lot design. [0:21:33, 0:21:39]: Parking lots shall have eight foot wide buffers adjacent to streets, eight foot wide islands between parking aisles. [0:21:40, 0:21:43]: And four foot wide separations for every twelve parking spaces. [0:21:44, 0:21:46]: Okay, and two H. [0:21:46, 0:21:48]: Parcel interconnectivity. [0:21:49, 0:21:53]: Provision shall be made for pedestrian access to adjacent commercial parcels. [0:21:53, 0:21:54]: Number three. [0:21:55, 0:21:56]: Architectural design. [0:21:57, 0:21:57]: A [0:21:57, 0:21:58]: three A [0:21:58, 0:22:03]: Scale the project scale shall be compatible with the scale of surrounding developments. [0:22:04, 0:22:05]: Three B. [0:22:05, 0:22:10]: Maximum height, the building shall not exceed four stories or fifty five feet. [0:22:10, 0:22:11]: Three C [0:22:12, 0:22:14]: Building, facade, styles, and colors. Three four A. This is four A. Utilities. [0:22:58, 0:23:02]: The developer shall comply with all requirements of City Stockbridge's public works department. [0:23:03, 0:23:10]: in providing sufficient water and sewer facilities to serve the proposed development, and these facilities shall be located underground. [0:23:10, 0:23:11]: Four B. [0:23:12, 0:23:27]: Site security. Whether or not a community is gated, flock cameras shall be provided at all site accesses. Four C easements. No encroachments or other actions shall disturb the Georgia Power Company easement to the east. [0:23:28, 0:23:29]: And finally for D. [0:23:30, 0:23:31]: Property maintenance. [0:23:31, 0:23:41]: An HOA or townhome association shall be established or a property management company shall be secured to maintain all common areas of the site. [0:23:42, 0:23:43]: Thank you so much. [0:23:44, 0:23:46]: Well, Mr Chairman, may I speak? [0:23:46, 0:23:47]: Yes, sir. Go ahead. [0:23:48, 0:23:53]: Uh Miss Logan, I uh there's two items I'm interested in that you didn't mention on that. [0:23:53, 0:24:08]: Have we done a traffic study or have we uh did a study with the citizen uh about this development? I know we're doing it tonight, but uh is there any prior uh commitments with the community from the developer? [0:24:09, 0:24:11]: None none that I'm aware of. [0:24:12, 0:24:20]: Well, I think I think that would should have been done. We had a uh CZIM meeting and some citizens came out. We had that uh two weeks ago. [0:24:21, 0:24:41]: Yeah, but the problem is she didn't list any of that here. So how how are we supposed to know? Well it's it's mandatory though. We that's a new uh process that we had a community zoning uh information meeting we have um this two weeks before the planning commission meeting. So we advertise that in the newspaper just like we advertise for the planning commissions and uh [0:24:41, 0:24:46]: Um male notices were sent out to all property owners within five hundred feet as required by code. [0:24:48, 0:24:50]: I I think also that [0:24:50, 0:25:10]: The board needs to be aware of that situation because we have the community coming near and they're looking for answers. And I can I can't give my answer because I don't I don't know that this actually took place. So in the future, it'd be nice for us to know this. If I'm looking through all these documents and I see two items missing. [0:25:10, 0:25:30]: missing that actually should have been in there. That's something we need to know when we're uh speaking with the community. Well we we can we can uh add that going forward. We can put a statement in there. Uh identifying when the community zoning information meeting was held and the date of the mail notices when they went out to the uh nearby residences. Thank you. [0:25:31, 0:25:33]: Oh, I'm sorry, I thought you were asking about a traffic study. [0:25:34, 0:25:43]: Yes, ma'am, I did. Uh but we we we just didn't have anything. I'm I'm just inquiring as a board. Right. Well a and it's a small development. [0:25:43, 0:25:46]: Awesome. Do any other board members have any questions? [0:25:48, 0:25:50]: Mr. Chairman, I have a question. [0:25:52, 0:26:12]: So my question is uh is is it um um is there is there a problem with us just leaving the property as it is or is there an option to maybe sell it to another a private citizen or [0:26:12, 0:26:13]: Someone else. [0:26:13, 0:26:22]: Well it's the city would have to hire a developer and um to come up with details for the plan. This is just a conceptual site plan. [0:26:22, 0:26:42]: Y yes, this this property is one of several properties that the city own owns downtown and is part of the overall downtown master plan. The city's trying to increase the density downtown and create new housing opportunities for residents to support to support our local businesses that are located downtown. So um the city will after the if the rezon [0:26:42, 0:26:48]: is successful, the city will market the property to a developer to develop the property. [0:26:50, 0:26:52]: Thank you, Ryan. Bice by share, is that all? [0:26:53, 0:27:11]: Why we meet it? Mr. Chairman. Ms. Logan, so what one thing I don't see here is any type of buffer between the existing homes and the uh proposed development. Is there anything that's being considered? Uh well let's see. I if I can pull up a enlargement site plane. I guess I can't. [0:27:12, 0:27:32]: Buffer is required um when they're incom when they're different zoning for a different zoning. For instance the SR and the PUD uh will would require a twenty five foot buffer. That's mandated by code. Okay. Um let me clarify, I'm sorry. So when I say a buffer, I mean [0:27:32, 0:27:35]: [1656.3, 1676.3]: Existing yes. Fencing over a certain height, existing trees being left in place, new shrubbery, or anything anything suggested. There will there will be a a a buffer. Uh I'm not sure exactly um how much vegetation will be pl be inside that buffer, but we will require a buffer between the equipment. [0:27:56, 0:28:00]: between the existing residences and the new development. Okay. Thank you. [0:28:02, 0:28:12]: Are are there any other questions from the commissioners? M Mr Chairman, may I please? Oh strategically I think this is a good product. [0:28:14, 0:28:20]: Uh particularly considering what the city is trying to do in the downtown area. [0:28:21, 0:28:23]: I think it's a great look. [0:28:24, 0:28:31]: I did have a concern and you partially addressed it in your conditions. Uh [0:28:33, 0:28:38]: During your presentation it appeared to me that the amenities were [0:28:40, 0:28:41]: Can scars. [0:28:42, 0:28:50]: Um and that was gonna be a question that I was gonna ask of you and I see here you've put it in there that that developers shall consider [0:28:50, 0:28:51]: Right. [0:28:52, 0:28:58]: Adding a dog park, a walking trail and a playground, and or barbecue picnic area. [0:29:00, 0:29:07]: I think that's great. I uh the the term consider d to me doesn't mean that it actually may happen. [0:29:08, 0:29:28]: Well those are you can consider it and then walk away and leave it. Well they these are all suggestions. These are all suggestions. I would like to see a little more stronger language.'Cause I mean we hold other developers pretty much the feet to the fire when it comes to amenities in developments. Um [0:29:28, 0:29:48]: Um I yeah, I I wouldn't wanna set a precedent because if the city owns the property. Right. We would kinda slack a slight in there by to go out to amenities. I would just like to see it but a little more stronger language than that. You agree with those [0:29:48, 0:29:50]: Suggested amenities? [0:29:50, 0:30:09]: Oh no question uh but I just have a problem with the the word consider. Oh okay. I I I think we could use a little s m more concrete verbiage than shall shall add. Shall shall provide. Sounds better than the sh we're we're gonna do it. You know, not that we we're gonna think about doing it. [0:30:09, 0:30:09]: Yeah. [0:30:10, 0:30:25]: That's what I'm feeling now. We we'll think about it, but I would rather hear we're gonna do it.'Cause that's what we require of other developers when they come before us uh i in their depro in their products. Well you can put that in the motion if you'd like. [0:30:26, 0:30:46]: Before we get there, um are you done? Go ahead. Thank you. And I'm gonna I'm gonna echo the sentiments of uh Board Member Doans, but I have a question really concerning about the uh compatibility with the surrounding areas. And so I wanna know uh how how are we gonna address as developers the concerns for the residents of Spanish Village and Pinehurst in regards to the potential impacts on [0:30:46, 0:30:59]: on their property values and their neighborhood character and that increase of density due to uh one, the townhomes that we're adding, but also the predominantly single family uh area that we're trying to add. [0:31:00, 0:31:05]: I think in the larger context uh context, as Ryan said, the goal is to [0:31:06, 0:31:06]: To [0:31:07, 0:31:25]: enhance the downtown area with more intense uses and that um it may be unlikely that that properties with that front of Henry Boulevard would be developed as single family maybe at the rear, which this is exactly what this proposes, but not at the front. [0:31:26, 0:31:34]: Uh so they s you know, the basically the back half of the property would be single family, just like the surrounding streets behind it. [0:31:35, 0:31:55]: It's compatible uh because there's no uh required change in density. Though there there is no comp plan associated with this, so it fits in with the character of the neighborhood as presented because the density will remain the same. Awesome. Thank you. Thank you, staff. Are there any other questions from the board members? Mr. Chairman may I finish [0:31:55, 0:32:00]: Oh my comment. Ms. Logan [0:32:01, 0:32:11]: You have four amenities choices in addition to the pavilion, two pavilions that you mentioned earlier. [0:32:13, 0:32:15]: It I don't wanna [0:32:17, 0:32:23]: issue a directive. That's not what my intentions are. But m perhaps it it would be [0:32:25, 0:32:27]: prudent to require the developer [0:32:28, 0:32:29]: To pick [0:32:30, 0:32:36]: Two of the four that you got listed in addition to the the two pavilions? [0:32:37, 0:32:38]: What do you think? [0:32:39, 0:32:57]: Well and also you might wanna think about maybe uh prov having the developer provide some active amenities and some passive amen pa active and passive amenities, maybe because it walking trail is more maybe active than the others. [0:32:59, 0:33:00]: You might even want to add something. [0:33:02, 0:33:11]: So maybe you consider a a dog park active, you consider a walking trail active, you consider a playground active. [0:33:13, 0:33:14]: I may ask you. [0:33:15, 0:33:27]: Uh that's a matter of interpretation. I think a more active would be something like uh tennis court or ball field and those kind of things. We don't see many of those anymore. Pickleball courts. [0:33:27, 0:33:33]: Well, you know, I don't wanna d detain the meeting hold it up unnecessarily. I would suggest [0:33:34, 0:33:40]: Did you uh and I'm gonna flip it back to you, that we remove consider [0:33:40, 0:33:47]: from the re requirements and recommendations and that we require the developer to add [0:33:49, 0:33:53]: At least two of the listed amenities from this list. [0:33:54, 0:33:58]: Okay. You could put that in your motion but we have to hold the public hearing first. [0:34:00, 0:34:00]: Uh. [0:34:00, 0:34:05]: I'm sorry, you want me to make a motion for it? No, well we have to have the public hearing first. Okay. Very good. Thank you. [0:34:06, 0:34:11]: And let me ask you this, uh, which which uh recommendation number are you looking at? [0:34:13, 0:34:15]: Uh six C [0:34:19, 0:34:25]: Uh it's actually two C. It's the first one on [0:34:25, 0:34:29]: The slide that says recommendations, slide number two. [0:34:30, 0:34:50]: Copy. Thank you. All right. Thank you, Miss Linda. If there are no other comments from the board, um, I will now open the public hearing for this case. If there is anyone who would like to speak in favor of rezoning case RZ 2025-OT O2, ask questions or [0:34:49, 0:35:00]: make comments, please come forward and tell us your name and address. And if there is anyone that would like that would like to speak other than in favor of the case, please come forward and tell us your name and address. [0:35:13, 0:35:32]: And did you already fill out a sheet for us, sir? Yes sir, I did. Awesome. Please state your name and address. I'll try and speak a little louder. My name is Richard Ordonis. I live at one one two Man Boulevard, right next to the proposed construction property. My wife Reeb and I have lived there for a year. Is the green button on? [0:35:33, 0:35:36]: Hello? Hello? It's just low. Yeah. [0:35:37, 0:35:54]: How's this? A little bit better? That's okay. I'll try and speak into that. Um my name is Richard Ordonis. My wife, Reba and I have lived on Mann Boulevard for over thirty years, and she was originally born and raised in Stockbridge. So we've been here for quite a while, seeing all the changes and everything that's gone through. Um [0:35:55, 0:36:02]: If I may, I've made a couple of I've made a map to show in reference to things I'm speaking, if I could get this to the [0:36:02, 0:36:05]: Pass it to look for the it was for you to be virtually. [0:36:14, 0:36:18]: All right. I have several issues uh in regards to the property [0:36:20, 0:36:21]: proposal for this development. [0:36:22, 0:36:23]: Number one. [0:36:24, 0:36:27]: How will the construction affect the creek and drainage? [0:36:28, 0:36:32]: area on Man Boulevard as well as on the other side of the proposed construction site. [0:36:32, 0:36:41]: There are natural underground springs on property located on Man Boulevard as well as on the proposed construction site that are a natural runoff into the creek. [0:36:42, 0:36:46]: Given the number of units proposed, these springs will be affected. [0:36:46, 0:36:50]: Also the runoff from the new property will cause more runoff towards current [0:36:50, 0:36:52]: businesses and housing in the area. [0:36:53, 0:37:03]: The property and creek also have runoff water from the odd numbered properties of the Man Boulevard, since the even numbered properties are downhill from the properties across the street as well as the street itself. [0:37:04, 0:37:06]: With a strong rainstorm. [0:37:07, 0:37:12]: The water in the creek can rise as much as six feet or more in a matter of minutes. [0:37:14, 0:37:15]: Number two. [0:37:15, 0:37:21]: If this construction is approved, consideration must be given for the safety of children re in regards to the creek. [0:37:22, 0:37:25]: Children have a natural inquisitive nature and they must be protected. [0:37:27, 0:37:28]: Number three. [0:37:29, 0:37:33]: In addition to the current traffic, there has been a splost in the city of expansion. [0:37:34, 0:37:36]: in the city for expansion of Rock Quarry Road. [0:37:37, 0:37:44]: Expansion along with new housing construction would cause more massive delays if expansion and construction coincide. [0:37:45, 0:37:49]: Онс до роккори род експерті ста експансію старс. [0:37:49, 0:37:53]: The backups will also affect traffic on Flippin' Road, North Henry Boulevard, [0:37:54, 0:37:58]: Highway forty two South, Eagles Landing and Hudson Bridge Road. [0:37:59, 0:38:06]: Any situations causing more delays, as was experienced recently at Eagles Landing and Rock Quarry intersection around the hospital. [0:38:07, 0:38:11]: Афект the entire area as drivers try and find alternate routes. [0:38:11, 0:38:14]: Which due to current traffic are themselves very busy. [0:38:15, 0:38:18]: North Henry Boulevard already is very congested. [0:38:19, 0:38:25]: Construction vehicles will be coming onto North Henry Boulevard, delaying traffic on North Henry Boulevard and Rock Coy Road. [0:38:25, 0:38:27]: causing additional backups. [0:38:28, 0:38:31]: Even if construction vehicles will be entering at a traffic light, [0:38:32, 0:38:36]: Which may not be possible or may not be allowed, it will delay traffic even more. [0:38:37, 0:38:43]: The width across Rockcoy Road is right at or extremely close to the width across the street of the [0:38:43, 0:38:48]: Where a fence from an unoccupied business and is is and a proposed commercial lot would be. [0:38:49, 0:38:52]: Considering the fact that the power lines are not in a straight line [0:38:53, 0:38:55]: And they come very close to our property. [0:38:56, 0:39:00]: A road inside the construction area would not fit between the power lines men boulevards. [0:39:01, 0:39:05]: Power line offsets would increase the distance on which a street would have to be. [0:39:06, 0:39:15]: And traffic from the proposed construction site would increase traffic tenfold on a constant basis since no traffic light could be at the entrance on North Henry Boulevard. [0:39:18, 0:39:29]: Number four, I would like to see a study done on the effects of existing homes the new construction would have regarding blasts from Rock Quarry, the quarry that exists on Rock Quarry Road. [0:39:29, 0:39:33]: The current blasts are explosions from the rock quarry. [0:39:34, 0:39:38]: The blasts from explosions are already felt by residents as their homes literally shake. [0:39:40, 0:39:43]: The property as it exists now allows some of the blast to be absorbed. [0:39:44, 0:40:01]: If construction is done, these blasts may cause more reverberations to existing homes from the new homes, eventually causing damage to the homes. In other words, when this vibrations come, they go through the property, but if they hit buildings and stuff, they reverberate and move out towards the older homes on either side. [0:40:03, 0:40:09]: And number five, the proposed construction site would destroy another wildlife habitat. [0:40:09, 0:40:13]: All wildlife, including deer, raccoons, opossums, etcetera. [0:40:14, 0:40:16]: We no longer have that habitat area. [0:40:17, 0:40:23]: With all recent expansions in the city as well as Henry County, they are having a difficult time trying to find areas to inhabit. [0:40:24, 0:40:36]: I have a few more things on mine, but due to time constraints I just wanted to limit it to that. But again, the map that I've given shows the springs, the creek, the flow of things, all those type of things that I've mentioned. Thank you so much. [0:40:39, 0:40:43]: Is there anyone that would like to speak in favor of the rezoning case? [0:40:45, 0:40:48]: Seeing none. Is there anyone that would like to speak aga [0:40:49, 0:40:51]: Yeah, against uh. [0:40:51, 0:40:53]: Please state your name and address for us, please. [0:40:53, 0:41:02]: My name is Doug Fodry. I live at 113 Man Boulevard. Uh I just moved here uh to Stockbridge about a year and a half ago. Love the town. [0:41:02, 0:41:22]: Uh the two concerns I have is one is I have about six deer that come up through my yard that come up from those fifteen acres, cross up through my backyard, and cross behind U-Haul into the cemetery. So I have those on camera, so it's a natural trail where they come through. So my concern is has there been a DNA? [0:41:22, 0:41:23]: [2485.0, 2490.6]: on the property, what it would affect with the wildlife, all the wildlife that's in that fifteen acres. [0:41:31, 0:41:33]: Uh the other concern I have is [0:41:34, 0:41:37]: Love the amplitude, but my house sits up on a hill. [0:41:37, 0:41:41]: And I do hear concerts in my house. So [0:41:41, 0:41:44]: If you cut down all the trees. [0:41:45, 0:41:49]: I won't have a natural barrier. So now the sound ordinance [0:41:49, 0:41:52]: on my house will increase during concerts. [0:41:53, 0:41:55]: And I've been to concerts. I love it. [0:41:55, 0:42:07]: But sometimes the concerts run late and they do get loud. So that's my concern. My two concerns is the sound barrier when you've cut all the trees down and the effect to wildlife. Thank you. [0:42:07, 0:42:13]: Thank you so much, sir. Is there anyone else that would like to speak against this rezoning case? [0:42:14, 0:42:14]: Please. [0:42:29, 0:42:39]: Good afternoon. My name is Brenda Callaway. My husband, Edward and I c uh Edward Callaway, we live on one oh two Sarissa, the street that that's gonna come right down. [0:42:39, 0:42:42]: And my concern is traffic. [0:42:42, 0:43:02]: Because it's already it's a small community, it's only five houses over there, right back here. And I'm like the gentleman said, we write down from the amphitheater and when they cut down the other trees, the noise gets really, really loud. And if you cut down all the trees behind us and build up all that property, all it's gonna bring [0:43:02, 0:43:09]: is a lot of traffic through that area'cause that's gonna be a ther a through street from what these [0:43:09, 0:43:11]: Uh the lady was saying it. [0:43:11, 0:43:18]: That's gonna be a street. They're gonna use Sarisa. That's my concern. That's why I oppose it. Because we've only been out here [0:43:18, 0:43:20]: We haven't been out here three years yet. [0:43:21, 0:43:23]: We like the community because it's quiet. [0:43:24, 0:43:44]: And to bring in that many properties and you know, that much traffic and that small of a space. You and uh all of our all the residents in that area is only two families that's under forty. Everybody is in their seventies and eighties. And that's my concern. It's the traffic and the noise. [0:43:43, 0:43:49]: And yes, I oppose it. Thank you so much. Is there anyone else that opposes [0:43:51, 0:43:51]: Yeah. [0:43:53, 0:43:59]: And if there's anybody else that actually wants to speak, if you could just stand here, uh please come up to the podium, sir, and we'll go from there. [0:44:02, 0:44:05]: Good afternoon. My name is Elba Callaway. [0:44:05, 0:44:22]: I would just uh wanna say something about uh traffic also. Uh I have I have uh I have five grandkids. And then the way we like my wife say, we stay right here on Sarissa Drive. So I have five grandkids. So if you got traffic going up and down the street, where are my kids gonna play at? [0:44:22, 0:44:31]: In the front yard. If you got cars going up and down the road on both sides. Plus the street is so narrow, so my thing there, how they gonna be up? [0:44:31, 0:44:34]: How there gonna be a way to get through? [0:44:34, 0:44:54]: to what you know what they plan on doing the instruction there. How there gonna be a way for them to get through when the street is so narrow as it is. And like I said, you got kids in the neighborhood and you got traffic going up and down the street. So then another thing, you're not gonna be able to walk out your house without seeing traffic going up and down the street. So you're gonna have to dodge [0:44:54, 0:44:56]: Plus we got a bag out the driveway. [0:44:56, 0:45:06]: How you gonna do bag out the driveway when you got traffic going up and down the street? So you just in a barn, you know. So that's my what I wanna say. Thank you so much, sir. Yeah, thank you. [0:45:07, 0:45:10]: May I if you can come up to the podium and say your name and address. [0:45:12, 0:45:32]: Hello, my name is Quisha Perpal. I live at 127 Bryan Street. I'm not as prepared as the others because I rushed from work. I'm sorry. But if we can look at the proposed site plan together, initially where you see here, it where it says total property, that rectangle that's there. [0:45:32, 0:45:52]: That's my house and my neighbor's home. I am directly connected to the 15 acres that you guys plan to use. I do understand that at some point it will have to be used because you want to use all 500 of your acres for redevelopment. But to be directly affected by this, um, the street that they've proposed here on the right side of the proposed plan. [0:45:52, 0:46:12]: That is actually my backyard and my neighbor's backyard. So it would then be a danger to our children. The demographic has changed a little bit on the street, as she said. Most of the neighbors are in their 70s and 80s. And in my case, my neighbors who are in their 80s have now passed away within the past year and a half. [0:46:11, 0:46:21]: So now we have younger couples, younger families moving in, and then this will pose a hazard and be dangerous for the children in addition to infrastructure. [0:46:21, 0:46:33]: Um, when we think about that, what are the plans that we have to expand North Henry Boulevard as far as an entry and exit point? Because if we're only using North Lee Street, when you combine that with [0:46:33, 0:46:43]: The little bit of residence that we do have, sixty seven units and the amphitheater. Now we're looking at an issue with traffic and safety for us. That'll be all. [0:46:43, 0:46:44]: Thank you so much. [0:46:45, 0:46:48]: Does anyone else wish to speak in regards to this case? [0:46:49, 0:47:03]: If not, I am now going to close the public hearing. The board will now have an opportunity to vote on this case. Do I have a motion regarding uh rezoning case RZ-2025-02? [0:47:03, 0:47:04]: emotion. [0:47:05, 0:47:06]: I push your motion, ma'am. [0:47:07, 0:47:16]: Mr. Chairman, Dave Planchon. Oops. Go ahead. One second. I had one from the vice chair to to deny correct. Yes. To deny our the rezoning case. Is there a second? [0:47:17, 0:47:25]: Mr. Chairman, I second. I have a motion and a second to deny rezoning case RZ 2025 02. Is there any discussion? [0:47:26, 0:47:31]: Hearing none, all those in favor of the denial, please signify by the sound of aye. Aye. Aye. [0:47:32, 0:47:33]: And you have a nay? [0:47:34, 0:47:35]: I'm sorry. [0:47:37, 0:47:38]: Y you have one. [0:47:39, 0:47:41]: Uh, yeah. [0:47:42, 0:47:45]: And all those against the denial? Please. [0:47:45, 0:47:46]: Uh [0:47:47, 0:47:49]: Is that two too? Mm-hmm. [0:47:51, 0:47:52]: So it is a tack. [0:47:54, 0:48:05]: So I guess I'll do the deciding uh mo uh vote and my vote is to deny the rezoning case RZ twenty twenty-four five-02. [0:48:05, 0:48:11]: Did you did you get my vote? Mine was a no. No? Right. Against against denying it. [0:48:11, 0:48:14]: Yes or no also. No. [0:48:15, 0:48:16]: No. [0:48:16, 0:48:17]: Okay, so it is [0:48:17, 0:48:19]: Three. Three, two. [0:48:19, 0:48:22]: Three to two. So three no's and two uh yes. Okay. [0:48:23, 0:48:24]: Oh, the motion players. [0:48:25, 0:48:29]: So that motion does fail. Um and do I hear a motion? [0:48:29, 0:48:38]: Mr Chairman. Yes, sir. I would move to approve the reverning case what is it, RZ? [0:48:41, 0:48:54]: twenty twenty five dash o two with the following conditions with regard to amenities that we talked about. I would like to uh [0:48:55, 0:48:57]: Remove the term consider. [0:48:59, 0:49:05]: On the additional amenities and I would like to add that the developer be required [0:49:06, 0:49:16]: to choose at least two of the four listed, in addition to the two pavilions that have already been included. [0:49:18, 0:49:24]: Developing all right. I have a motion with two amendments to the recommendation. [0:49:24, 0:49:25]: Is there a second? [0:49:27, 0:49:36]: Uh Chair Chairman, can I speak? Sure. Uh we also need to consider uh fence and some form of uh sound barrier. [0:49:37, 0:49:49]: Uh in that and then I also like to make a statement to the public. Regardless of whether we pass this or not, it still can be passed by the city council. So the uh [0:49:50, 0:50:03]: situation we're doing tonight, we're presenting the case, but it does not necessarily mean that it will go through because the city council has the last say so on what we do on this board at the end of the day. [0:50:04, 0:50:11]: Thank you. Thank you for confirming that this is a recommending body. Uh the council will then vote. But is there a second to the current motion on the floor? [0:50:14, 0:50:15]: A second it, Harold. [0:50:15, 0:50:21]: Right, is a motion by uh Mr. Dumas and a second by Mr Thibodeau. Is there any more discussion? [0:50:22, 0:50:42]: Mr. Chairman, that may not be the right time, but I just want to remind everybody all we're doing here tonight is bringing the zoning for this property in line with the land use plan. We're not approving any developments, we're not approving, you know, any any building going on there construction at this time. We're just approving the rezoning of the property to bring [0:50:42, 0:50:50]: it in line with the land use plan. So you already voted no to do that, so that kind of ends the case. [0:50:52, 0:51:11]: Mr. Staman, let me make a statement real quick. I agree with Mr. Plungin on there in that I I'm really, to be honest with you, a bit confused why we're taking up the consideration of additional amenities or changes to the amenities when we just denied the rezoning. Right. I think that's what we're trying to get to here. Yep. [0:51:13, 0:51:17]: I'm sorry that I didn't hear what he said. [0:51:17, 0:51:18]: So uh [0:51:20, 0:51:39]: He basically just said we denied the rezoning, right? Uh but you do have a motion because we have to act on it. So you do have a motion to we didn't deny the rezoning. I know that's what I'm about to come back to. So we since they did not pass, there is a motion now for the approval of the rezoning case with the two amendments that Mr. Dumas has stated. [0:51:40, 0:51:49]: Which was the removal of the term consider and then also to require something from our developer, correct? For future tense. [0:51:50, 0:51:54]: to add at le at least two of the four minutes that are listed. [0:51:54, 0:52:03]: Okay. So so his recommendation or his motion was to approve the rezoning case uh with the with the [0:52:04, 0:52:19]: order to remove the term consider from recommendation two C when it comes to amenities and then also to make sure that uh developers are not are able to choose two out of four of the recommendations instead of all using all four. [0:52:21, 0:52:29]: First mo motion failed. I think there's some confusion about whether it passed or not. But it's a Oh, great. Yeah. The first motion failed. This is the second motion. [0:52:30, 0:52:31]: So that's it. [0:52:32, 0:52:44]: No, you no you have to vote on on this motion right here, Mr. Planchan. The first one failed. Are you gonna amend something that failed? The the first one the first motion didn't pass. It it uh went down three to two. [0:52:45, 0:52:47]: So now there's a there's a new motion on the floor. [0:52:50, 0:53:05]: Thank you, Ryan. I have a motion and a second on the floor. All those in favor of the motion to approve, uh with the terms listed by uh board member Dumas, please signify by the sign of aye. Aye. [0:53:06, 0:53:10]: Any opposed? Opposed. Opposed. So once again it is three, two. [0:53:13, 0:53:14]: At that point I have to [0:53:15, 0:53:33]: There's some confusion on what Mr. Planchin is voting. Are you voting to deny or approve? Mr. Planchin's motion was to approve with the uh with some conditions to the uh to the recommendation. It's it's two down. It's uh Mr. Dumas and Mr. Tibetal, it's two, and then Mr. Planchon made three, right? [0:53:35, 0:53:42]: So that means three, four, he said no. He said no. Correct. Okay, well This had voted no. This half voted yes. [0:53:42, 0:53:45]: Well no, it's three against two. [0:53:45, 0:53:48]: One, two, three no's and two yeses. [0:53:48, 0:54:00]: Yeah. Mr. Chairman, maybe I suggest and we make sure we do a hand vote. Shows are in the air so everyone can see. So we'll do a hand vote. Um all those in favor? [0:54:01, 0:54:10]: of R Z twenty twenty five dash O two the motion um and second uh with those conditions please signify with your hand in favor. [0:54:13, 0:54:15]: All those opposed? [0:54:16, 0:54:17]: Opposed. [0:54:19, 0:54:21]: So the motion to approve [0:54:24, 0:54:35]: So the first motion should have counted, yeah. The very first motion should have should have been the one that pr that passed to deny. So both motion both motions have failed? [0:54:37, 0:54:40]: No, there the first motion. [0:54:41, 0:54:43]: should have denied it. [0:54:45, 0:55:05]: The first worst motion was a motion to deny. It was three two. Rezoning. Right? We denied the rezoning. Correct. Okay. No. The first motion. No, the first motion was a motion to deny. The first motion, as I understood it, was a motion to deny the rezoning. Right, correct. That's correct. That's what you just said. And that motion. [0:55:05, 0:55:18]: Uh failed. Three two. No, we approved the denial. So we did not. So let me explain why we missed something. Okay. If we didn't approve the denial, then we approved the acceptance. [0:55:19, 0:55:20]: Is that [0:55:20, 0:55:26]: The motion was to deny the rezoning. Right. [0:55:26, 0:55:30]: And that motion failed. And did it pass? No, we did not pass. [0:55:31, 0:55:46]: Okay. So now we're doing one thing. And that motion was to approve with conditions. With two to three of a vote. And that motion failed. [0:55:47, 0:55:58]: Failed also? Yeah. Okay. I I I didn't discount on the second one. Yeah, yeah, so that's why Gordon s uh not Gordon Ryan said that we had to go back to the first motion because ultimately it did not either way. [0:56:00, 0:56:02]: With the votes. I missed something. [0:56:03, 0:56:04]: Okay. [0:56:06, 0:56:26]: So, Mr. Chairman, could you be clear for the board? Yes, sir. So the rezoning failed. Yes, sir. And the second motion with changes also failed. I think we're trying to get on the record. Yes, sir. Okay. Uh so on the record, uh the rezoning did fail. The second motion failed as well as the first motion. So therefore, we go back to the first. [0:56:26, 0:56:42]: first motion with my tiebreaker vote and would take it down to the four to two. And so therefore the art the rezoning tiebreaker is four to it. So no I'm adding an extra point. Are are we lost? Yeah. How how are we confused? [0:56:49, 0:56:57]: 'Cause it's it's two yeah, right. How about if we just um ask each member whether they're in favor or not in favor. Simplify matter. [0:56:58, 0:56:59]: Sounds like a plan. [0:57:00, 0:57:07]: Okay. When I when I say your name, board member, uh please say in favor or not in favor of the rezoning case. [0:57:08, 0:57:12]: Board member Mitten. I am opposed to the rezoning. [0:57:15, 0:57:19]: Uh, thank you. Board member Planchet. [0:57:22, 0:57:29]: I I approve the rezoning. Like I said, it's just bringing that piece of property in line only the zoning in line with the land use plan. [0:57:29, 0:57:32]: That you know, and the city owns the property already, so [0:57:34, 0:57:35]: Vice Chair? [0:57:37, 0:57:38]: I oppose. [0:57:41, 0:57:42]: Board Member Doumas. [0:57:43, 0:57:44]: Our proof. [0:57:46, 0:57:47]: Board member Thibodeau. [0:57:47, 0:57:54]: Uh approved. Right. The rezoning case RZ twenty twenty two dash O five is approved. [0:57:55, 0:57:57]: Three to two. Thank you. [0:58:00, 0:58:12]: So Mr. Chairman, I have uh um those approving are Stanley Dumas, Harold Thibodeau and David Planchon. Those opposed are Tremika Walker and Anthony Minton. Is that correct? Yes. [0:58:12, 0:58:25]: All right. The next item on tonight's agenda is project updates. Do we have any project updates from staff? Uh no, not tonight. All right. Thank you. Uh there are any staff comments? [0:58:25, 0:58:31]: No, not tonight, Chairman. All right. The next item is board comments. Do any board members have any comments to make? [0:58:34, 0:58:42]: I I have one. Please. I I I think we need to kinda create a little bit more clarification because the night was really confusing. [0:58:43, 0:58:49]: As to which way you need to vote and which way you shouldn't vote. I think we uh need to work on the clarification because uh [0:58:51, 0:58:53]: It wasn't good tonight. [0:58:54, 0:58:58]: I'll make sure we work on that board member. Uh any other board member comments? [0:58:59, 0:59:13]: Awesome. I'm gonna I am going to say happy women's uh history month. Uh and thank you to all the women, especially our only female board member on this board for all that you do. Uh with that I'll take a motion to adjourn. [0:59:14, 0:59:17]: Mr. Chairman, this is Stan Doans. I move to adjourn. [0:59:17, 0:59:24]: This is Dave Planchet and I second it. I have motion to second. All those in favor? Aye. Aye. All right. Have a good evening, everyone. [0:59:32, 0:59:39]: We can understand I'm going one by one. Now, it's twenty twenty eight PM. What about one?
