[0:05:57, 0:05:58]: Mm-hmm. [0:05:58, 0:06:09]: Thank you so much. Welcome to the City of Stockbridge Planning Commission meeting for April seventeenth, twenty twenty five. I am Jaden Williams, Chairman of the City of Stockbridge Planning Commission. [0:06:10, 0:06:17]: There are a few protocols that I want to make you all aware of before we start this meeting. Be aware that [0:07:00, 0:07:09]: These are he these hearings are not a debate or an opportunity to ask questions which must be answered by the individual tonight, but are merely an opportunity to present information to the Commission. [0:07:10, 0:07:30]: Other than the applicant, no person may speak more than once. The applicant may reserve part of his speaking time as a rebuttal and may speak next and last and may use the entire 10 minutes allotted for the pro side of the application. Other than the applicant, no person may speak longer than five minutes. If you have a cell phone or other electronic device, I ask you to either power [0:07:29, 0:07:32]: Power them off or put them in silence mode. [0:07:32, 0:07:40]: If anyone wishes to speak tonight, please fill out a speaker's form, which is available on the table up front, and hand it to a staff member before approaching the podium. [0:07:42, 0:08:02]: After each item or case is called, we will hear from the city staff and then we'll hear from the applicant or their respect representative about what their plans are for the property, along with any other relevant informate information they wish to present. The commission members will be free to ask questions at any time before the vote on a project, following the applicant, anyone who [0:08:02, 0:08:07]: who wishes to speak for or against the project, or to just ask a question when they have the opportunity to do so. [0:08:07, 0:08:15]: Which each side is respected and restricted to a five, ten minute maximum, or a time may be waived at the discretion of the presiding official. [0:08:16, 0:08:30]: If questions are raised, we may ask the applicant to speak again. Afterward, we will call for a motion in a second, have a necessary discussion, and if the matter is not tabled, we will vote to recommend approval or denial of the application. This commission is only a recommending body. [0:08:31, 0:08:45]: The items will be heard by mayor and council whether we recommend approval or recommend denial. Unless they are tabled, these items will be heard by the mayor, the city's mayor and council at their next meeting on Monday, May 12th, 2025, and the items will be voted upon at that meeting. [0:08:46, 0:08:50]: At this time, I'm gonna ask for an adoption of tonight's agenda. [0:08:54, 0:09:05]: Mr. Chairman, I move that we adopt the agenda. That's permitted. Mr. Chairman, I second. I have a motion by Mr. Doomis and a second by Mr. Planchin. All those in favor, please indicate by the sound of aye. [0:09:05, 0:09:07]: All those opposed? [0:09:09, 0:09:23]: So moved. Moving on, may I have a motion to approve or before you commissioners you all have the meeting minutes from the last meeting. Please review those. Once finishing, please uh I'll take a motion for the approval of the last meeting minutes. [0:09:25, 0:09:30]: Mr. Chairman, unless anybody wants it read, I make a motion we approve the minutes from last meeting as written. [0:09:31, 0:09:51]: And Harrow, I second it. I have a motion by Mr. Planton and a second by Mr. Thibodeau. All those in favor, please indicate by the sound of aye. Mr. Chairman. Please hold. Yes, sir. Before we vote, I do have one correction, please. Sure. Uh board action on RZ 2025. [0:09:51, 0:10:11]: The last paragraph is inaccurate. It's suggesting that the uh the uh RZ 2025-02 was approved by vote of 3-2 without any conditions. [0:10:11, 0:10:13]: That is not correct. [0:10:15, 0:10:26]: If you recall at that meeting there were two motions. The first motion was made to deny the request and it failed. [0:10:28, 0:10:31]: The second motion was made to approve [0:10:31, 0:10:33]: What conditions? [0:10:33, 0:10:36]: Those were the only two motions on the floor. [0:10:37, 0:10:47]: I think the confusion was on the vote count, not on the motion itself. Correct. So the motion was a approved three two with conditions. [0:10:47, 0:10:55]: Correct. Can we um can we make those well I'm gonna actually uh ask Mr. Plinch and did you make the motion, sir? [0:10:57, 0:11:08]: I'm gonna ask that uh we can get this fixed with staff at the end of the meeting. With the corrections. Thank you so much. Is there a second to this? A second here. [0:11:10, 0:11:11]: To what was then? [0:11:14, 0:11:25]: I I I think I'm uh I'm agree with uh Mr. Doom is here. We did have some conditions that he brought towards the commission that we discussed and was approved therefore. [0:11:27, 0:11:30]: Uh may I speak, Mr. Chairman? Please. [0:11:30, 0:11:40]: Uh Miss Logan, uh I know you recorded the meetings. Can you uh go back to that and and listen and s see exactly what was saying? [0:11:43, 0:11:50]: when I was preparing the minutes and I played it back multiple times to ensure accuracy. [0:11:52, 0:11:56]: But we we haven't heard it. So is there any way that we can listen to it? [0:11:58, 0:11:59]: Mr. Chairman. [0:12:00, 0:12:10]: Yes, uh if we could look at the bottom of page four of the minutes, this might be what we're referencing. If uh Commissioner Doomis could confirm that. [0:12:13, 0:12:33]: Yes, here are the conditions here. Mr. Dumas. I'm clear on the conditions. I I was just concerned with the paragraph, the final paragraph on the board RZ 2025-S2. It specifically says that it was a three-two vote without any condition. [0:12:33, 0:12:34]: And that is not accurate. [0:12:34, 0:12:35]: Yes, sir. [0:12:38, 0:12:38]: Mr. Chair. [0:12:40, 0:12:40]: Please. [0:12:41, 0:12:44]: May I ask a motion to deny until we review? [0:12:45, 0:12:52]: If Mr. Planchton will uh rescind his motion to approve so that we can further review as a commissioners to get that set. [0:12:53, 0:12:54]: Yes. [0:12:54, 0:13:02]: Okay. Uh that we have a motion to deny the last meeting minutes until the commission can review um and add those conditions. Is there a second? [0:13:03, 0:13:10]: I second it, Harold. All right, there's a motion by Miss Walker and there's a second by Mr. Thibodeau. All those in favor, please indicate by the sound of I. [0:13:11, 0:13:13]: Uh uh. Any opposed? Aye. [0:13:14, 0:13:33]: Uh it is a what four one? Four one vote to deny, motion to deny. You can approve you can make changes to the minutes during the meeting. You don't have to go through that proceeding. What the commission's wanna review because the staff said that they saw they didn't hear any errors, so we want to s go back and watch it ourselves. Okay. [0:13:35, 0:13:40]: Thank you so much for that. Now moving on to the next item on the agenda. [0:13:43, 0:13:57]: Next item on tonight's agenda is a special use permit case, SP-2024-03. I will read it into record. After that, we will have a presentation from the staff in a public hearing. Then the board will vote on this case. [0:13:58, 0:14:17]: Consideration of a request for a special use permit to allow personal care home to operate on property at two hundred seventy SHIELTS Road. Applicants as agent is Shoner John. The property is located in land lot seventy of District twelve and it contains one point forty seven more or less acres. The staff will now give its presentation of this case. [0:15:06, 0:15:08]: Good evening, ladies and gentlemen. [0:15:09, 0:15:10]: Good evening. [0:15:14, 0:15:25]: This is a PowerPoint presentation for special use permit case number SP 2024 at 270 Shields Road, special use permit case. [0:15:25, 0:15:26]: Um [0:15:28, 0:15:35]: The property is uh located on Shields Road on the east side. Here's the aerial photo. [0:15:37, 0:15:43]: The applicant is Shauna John, uh parcel number S100204-1000. [0:15:43, 0:15:45]: One point four seven. [0:15:45, 0:15:47]: Acres approximately. [0:15:47, 0:15:48]: And [0:15:49, 0:15:53]: Property has existing single family detached dwelling located on a hill. [0:15:53, 0:15:57]: With the driveway leading up to a side entry, two car garage and a turnaround area. [0:15:58, 0:16:02]: Um it's used as a single family dwelling and has twenty two ninety six square feet. [0:16:03, 0:16:05]: With four bedrooms and two baths. [0:16:05, 0:16:07]: Um the applicant states there's also [0:16:07, 0:16:08]: Two bedrooms in the basement. [0:16:09, 0:16:16]: Uh surrounding uses are other single family detached dwellings and some vacant parcels, property zones, suburban residential. [0:16:17, 0:16:21]: uh as well as the surrounding area, future land use designation, medium density, [0:16:21, 0:16:23]: Residential and this is appropriate. [0:16:24, 0:16:26]: future land use designation for a personal care home. [0:16:30, 0:16:36]: Uh the applicant requests uh to a special use permit to operate a personal care home with [0:16:36, 0:16:37]: Six residents. [0:16:37, 0:16:42]: Um, I won't read this but I have a definition here of a personal care home in case anyone [0:16:43, 0:16:44]: Uh needs that. [0:16:45, 0:16:48]: Персонал Кера Хом із дистінгіш фронтом other симле. [0:16:49, 0:17:05]: uh type developments such as a daycare center, group daycare home, and um family daycare, those three uh either are for children or for less than twenty-four hours. So that's how personal care home is different. [0:17:05, 0:17:13]: Um the applicant purchased the property um last year and obtained a zoning verification letter from community development. [0:17:14, 0:17:14]: Um [0:17:14, 0:17:17]: applied for a business license, it was not issued at that time. [0:17:18, 0:17:27]: She did appear at a CZIM meeting last September fourth and a planning commission meeting last September nineteenth, but the case was deferred at that time. [0:17:28, 0:17:33]: Um she also submitted a deferral letter on October twenty ninth, twenty twenty four. [0:17:33, 0:17:35]: Uh so that she could obtain her [0:17:35, 0:17:38]: state license for personal care home. [0:17:38, 0:17:40]: She now has a pain that um [0:17:40, 0:17:43]: January twenty eighth, twenty twenty five and [0:17:43, 0:17:45]: second thing she needed from the state was [0:17:45, 0:17:49]: a medication certification this would allow her to [0:17:49, 0:17:53]: personally administer any medication to the residents living there in the home. [0:17:54, 0:17:56]: Um and I verified. [0:17:56, 0:17:57]: Um [0:17:57, 0:18:02]: uh through an online search, uh the presence of this medication certification. [0:18:03, 0:18:06]: Here's a zoning map of the property. You see that it's [0:18:06, 0:18:10]: um within a suburban residential uh zoning district. [0:18:11, 0:18:14]: And medium density residential the entire area. [0:18:16, 0:18:18]: Here is a survey of the property. [0:18:19, 0:18:19]: Um [0:18:20, 0:18:23]: There is a long narrow driveway going up the hill and a [0:18:23, 0:18:25]: The side entry garage with a [0:18:26, 0:18:27]: А тернораун арія. [0:18:27, 0:18:29]: Um to back out of the garage. [0:18:31, 0:18:41]: Uh this is the copy of the state personal care home license. Now it does say that it only allows three residents, whereas the applicant has requested six [0:18:42, 0:18:42]: Um [0:18:45, 0:18:48]: This other certificate is her um [0:18:48, 0:18:51]: Shows that she completed a course for the medication certification. [0:18:53, 0:18:56]: So there's some information about the interior of the home. [0:18:56, 0:19:00]: Um she proposes to have two residents per bedroom. [0:19:00, 0:19:01]: Um [0:19:02, 0:19:06]: and each resident must have at least eighty square feet. [0:19:06, 0:19:09]: There's a master bedroom and two other bedrooms on the main floor. [0:19:10, 0:19:13]: Um the applicant has submitted what she calls a business summary. [0:19:13, 0:19:15]: That was just submitted to us. Um [0:19:16, 0:19:17]: Лас вік [0:19:17, 0:19:30]: describes um admission procedures and op business operations of the home, hours of operation, when there'd be deliveries. There would be two employees initially to care for the residents around the clock. [0:19:33, 0:19:53]: Uh here's and she's also arranged for security measures of the facility and the the residents, uh storage of medication, um grab bars for the residents and emergency systems um and obtain the fire hydrants and evacuation. [0:19:53, 0:19:55]: procedures and so forth. [0:19:55, 0:19:59]: And has submitted uh photographs of some of these items. [0:20:00, 0:20:03]: This is a a sketch of the floor plan of the interior of the home. [0:20:04, 0:20:08]: Uh, we did a number of analyses per the UDC. [0:20:09, 0:20:09]: Um [0:20:10, 0:20:14]: There are requirements for personal care homes with three or more residents. [0:20:14, 0:20:16]: Uh must comply with state laws. [0:20:17, 0:20:23]: Uh the the exterior of the home it must still look like a single family home and not be evident from the outside. [0:20:23, 0:20:35]: that anything else is uh happening there. Um must meet parking standards and needs a business license and must meet the fire building and fire codes. [0:20:39, 0:20:42]: The minimal Miss Logan, could you go full screen please? [0:20:43, 0:20:44]: Let's see. [0:20:50, 0:20:54]: Down the lower right hand corner should be the button. [0:20:56, 0:20:57]: That's one. [0:20:59, 0:21:00]: Yeah, is that better? [0:21:03, 0:21:04]: There you go. [0:21:04, 0:21:05]: Okay. [0:21:05, 0:21:06]: Mm mm mm. [0:21:11, 0:21:21]: Needs a mini property needs a minimum lot size of one acre which it has and not be within fifteen hundred feet of another similar facility, not being in the subdivision, it meets those requirements. [0:21:23, 0:21:24]: Um [0:21:25, 0:21:33]: There there's other information here if if if needed. These are just the different analyses out of the UDC that we looked at. [0:21:40, 0:21:45]: Uh some of the requirements are outdoor lighting, uh sufficient parking. [0:21:46, 0:21:47]: Um [0:21:48, 0:21:50]: Hours and manners of operation. [0:21:51, 0:21:52]: Protective screening. [0:21:53, 0:21:55]: Ingress and egress. [0:21:56, 0:21:58]: So these are our conclusion, the number of residents [0:21:59, 0:22:03]: Uh, although the applicant proposes to have six residents, her state license only allows three. [0:22:04, 0:22:04]: Um [0:22:06, 0:22:11]: type of use. We don't believe that a personal care home is the best use of the property in terms of its location. [0:22:12, 0:22:14]: in an established residential area. [0:22:14, 0:22:18]: Uh we've identified potential adverse um [0:22:18, 0:22:20]: Impacts on the surrounding neighborhood. [0:22:21, 0:22:21]: Um [0:22:22, 0:22:25]: The the driveway, access to the driveway, as I mentioned. [0:22:25, 0:22:29]: Um you have delivery vehicles coming occasionally. [0:22:30, 0:22:35]: Um, might be some conflicts, them going up and down the driveway. Not not a good place to [0:22:35, 0:22:36]: Park or turn around. [0:22:37, 0:22:37]: Um [0:22:38, 0:22:39]: Or not a sufficient parking. [0:22:40, 0:22:43]: And there's no protective screening like a fence for [0:22:43, 0:22:52]: to protect um visual impacts on the neighbors and also protection for the residents themselves to keep them on the property. [0:22:54, 0:22:58]: Uh in view of those uh conclusions we recommend denial of this case. [0:22:58, 0:23:01]: However, we have identified in case a city council [0:23:02, 0:23:07]: uh wishes to approve S P twenty twenty four oh three, then we recommend [0:23:07, 0:23:27]: Three conditions. Number one, that no more than three residents occupy the personal care home, because that's what the state license limits are to. Number two, that driveway and parking area area be modified to accommodate additional vehicles. And number three, that appropriate screening and fencing be installed for the safety of the residents and protection. [0:23:27, 0:23:28]: protection of the neighbors. [0:23:31, 0:23:34]: Uh Mr President, may I speak? [0:23:34, 0:23:35]: Go ahead, sir. [0:23:35, 0:23:41]: M Ms. Logan, uh I I understand all the uh requirements that are here. [0:23:41, 0:23:45]: For the applicant. The the only question I was thinking about [0:23:46, 0:23:56]: Did did all this information was presented to the applicant long before they applied for us to uh [0:23:56, 0:24:02]: For them to come to this meeting. H did did you give them all the particulars about what's required? [0:24:04, 0:24:09]: I mean you're giving it to us, but did you give that to the applicant? [0:24:10, 0:24:14]: Initially we had another staff person communicating with the applicant. [0:24:15, 0:24:16]: Um but yes. [0:24:16, 0:24:29]: So you you're saying prior to this meeting that the applicant had all this information? That was communicated um, you know, months ago before the uh planning commission meeting. Uh this September Planning Commission meeting. [0:24:30, 0:24:31]: Thank you. [0:24:33, 0:24:35]: Thank you. Any other questions from any of the commissioners? [0:24:38, 0:24:49]: I have a question. Um, let me see. So I I know we've this case has been brought to us before and we deferred it until she got the required certifications. Right um [0:24:50, 0:24:57]: One, I wanted to ask the county, the city attorney, can we even approve a six if she if she's only been approved for three by the state? [0:25:04, 0:25:16]: Thank you so much. Uh and then lastly, uh for for us, it's a self care home where s w has she met the requirements for the city to to conduct the business in her home? [0:25:17, 0:25:22]: When you did your review, your staff review the report, did she meet the r the said requirements that we have? [0:25:24, 0:25:33]: So this this staff report was prepared after she obtained her two state licenses, state license and state medication certification. [0:25:34, 0:25:54]: So so there's a a conflict in this in the two city codes. You have the city co city code of ordinances and then you have the zoning ordinance. The zoning ordinance allows for um personal care homes. However, the city code of ordinances does not and it does not have any provisions to regulate. [0:25:54, 0:26:00]: Personal care home. So currently there are no provisions in the city to regulate that type of business. [0:26:01, 0:26:02]: All right. [0:26:03, 0:26:03]: Please. [0:26:04, 0:26:21]: That's it, Chair. So uh my question is, can we approve it with the three residents that her license allots for versus y uh trying to approve it with the six residents that she's requesting? [0:26:22, 0:26:25]: You can only approve it for three [0:26:25, 0:26:27]: That's what the state license uh [0:26:27, 0:26:45]: Right. Allows and there's also um I'm trying to find it here, a prohibition that you cannot um allow any more than what the state license is. I'm sorry. I I was just asking, can we vote to uh approve it for three versus six, which she's requesting? [0:26:45, 0:26:51]: Yeah, so it's a public hearing. So I know we'll probably discuss it a little bit further. I'm gonna open it up if Miss Linda's done, I'm gonna open it up to the applicant. [0:26:51, 0:26:52]: Um [0:26:53, 0:26:55]: I won wanna mention I found this [0:26:55, 0:27:08]: There is a provision called Rule 111862.063, which states as follows: a licensed personal care home must not serve more residents than its approved licensed capacity. [0:27:10, 0:27:16]: Yep. All right. Thank you, Ms. Linda. I'm gonna ask for the go ahead. You were saying something? Okay. [0:27:16, 0:27:20]: I'm gonna ask for the applicant, Ms. Shona John, is she here? [0:27:20, 0:27:21]: If you were please. [0:27:26, 0:27:34]: Are there any questions from the commissioners to the applicant? [0:27:36, 0:27:42]: Uh I'm I'm kinda hold on one second, Miss uh let me let her fill that out a little Okay. [0:27:44, 0:27:45]: Good afternoon to all. [0:27:46, 0:27:52]: Um first and foremost, um make sure the green button is on on the mic at the bottom. Okay. [0:27:52, 0:28:02]: Excuse me about that. Yes. Um the reason for three, I applied for three. We cannot apply for [0:28:02, 0:28:04]: C um more than three. [0:28:04, 0:28:06]: In the city of Henry. [0:28:06, 0:28:07]: Henry County. [0:28:08, 0:28:08]: From the state. [0:28:09, 0:28:21]: You gotta have this um permit before you can allow they can allow you to have more than three, but they are allowing six. It is only because I did not have the permit. [0:28:22, 0:28:23]: From the city. [0:28:23, 0:28:25]: That is why I couldn't put it in. [0:28:25, 0:28:27]: But they have asked me to [0:28:27, 0:28:29]: Get the permit and then [0:28:29, 0:28:31]: reapply for an increase. [0:28:31, 0:28:36]: This is the only reason they gave me the three. I applied for the three. [0:28:37, 0:28:42]: So it's not that that's what they permitted me. That is what I applied for for that reason. [0:28:44, 0:28:45]: Mr. Tibble, you had a question? [0:28:46, 0:28:55]: Uh yes. I I was wondering, did you talk to the city about your qualification? Did they give you all the information that you needed to uh [0:28:56, 0:29:04]: qualify for anything pertaining to the city on the zoning? Up twenty hours today I've been begging and pleading. I even [0:29:05, 0:29:10]: Ask her, I said it wasn't her, it was Miss Um What's her name? [0:29:11, 0:29:13]: K no, Kendra Kendra. [0:29:13, 0:29:13]: Jack. [0:29:14, 0:29:19]: Miss Jackson. Okay. Now I ask her because Go ahead. Go ahead. [0:29:19, 0:29:21]: The first time when I came here. [0:29:22, 0:29:25]: She told me she sent me a notice to bring a proposal. [0:29:26, 0:29:28]: An hour before the meeting. [0:29:28, 0:29:31]: And I told her, how do you expect me to? [0:29:31, 0:29:35]: um prepared a proposal in an hour when I have to drive to come here. [0:29:36, 0:29:40]: She told me, Well just stomp something for your just say what's in your mind. [0:29:41, 0:29:53]: I'm not a public speaker, like I said, it gets me nervous. But um I was doing the best that I can. She told me that you'll have somebody there with you to help you out, you know, but when I came here I was alone. [0:29:53, 0:29:57]: And she had a long list of how many reasons why I shouldn't. [0:29:58, 0:29:59]: Get the the the permit. [0:30:00, 0:30:03]: She told me that she um [0:30:03, 0:30:10]: She advised she said the driveway wasn't right. I don't have enough of um [0:30:12, 0:30:30]: backyard parkings, I didn't have the uh license um for medication administration administrated, I didn't have uh um what else she said I didn't have and all she was saying that I didn't have, I had all of it, but never asked to me. [0:30:30, 0:30:34]: So I emailed her when I left here and I said [0:30:34, 0:30:37]: A lot of what you said was a lie. I don't like that. [0:30:38, 0:30:41]: I like people to be up front with me because [0:30:42, 0:30:44]: I'm trying to do something. I have spent [0:30:45, 0:30:47]: More than I can afford. I had to take loans. [0:30:48, 0:30:49]: To get to where I am right now. [0:30:50, 0:30:52]: And I said, You just want me to give it up. [0:30:53, 0:30:56]: And call it call it the day. That's not the way things work. [0:30:56, 0:30:57]: I said, you gave me the permit. [0:30:58, 0:31:02]: You gave me the permission to broad that property. I didn't go and do it on my own. [0:31:02, 0:31:03]: I went. [0:31:04, 0:31:07]: To zone in and I have the letter right there that stated I could have [0:31:08, 0:31:08]: Two. [0:31:09, 0:31:13]: without the special use permit and if I want free up [0:31:13, 0:31:15]: I have to get a special use permit. [0:31:16, 0:31:24]: There there was no limit, she didn't say to six or four or five, but I know from the state I can only get six in this county. [0:31:25, 0:31:33]: But none of these things, they have not presented me with anything at all. Because I'm saying I even told Miss Um [0:31:34, 0:31:35]: Kendra. [0:31:35, 0:31:41]: that I felt like everybody was working against me. I felt like I was alone. [0:31:41, 0:31:45]: Standing alone with everybody against me. I said, You told me something. [0:31:46, 0:31:46]: But [0:31:47, 0:31:50]: You wrote something else. I say, what is the meaning of that? [0:31:51, 0:31:52]: She told me she was not the one who wrote it. [0:31:53, 0:31:55]: I told her lies will come back to bite you. [0:31:56, 0:32:00]: I don't believe in lies, I don't believe in hypocrisy, I don't believe in people. [0:32:01, 0:32:04]: You know, two faces. Tell me what it is. [0:32:04, 0:32:06]: I ask what do I need? [0:32:06, 0:32:16]: Tell me what I need to reach your standard so I can do what I need to do. Yes ma'am. Never give it nothing nothing to me. And I have pictures to show the property. [0:32:16, 0:32:21]: what I have for safety and the driveway that everybody's so concerned about. [0:32:21, 0:32:27]: I can show you the pictures of the driveway. Please give the pictures to staff. Are there any other questions from the commissioners? [0:32:28, 0:32:30]: Yes, Mr. Chairman. [0:32:30, 0:32:38]: So ma'am, I have a question for you if I could. Yes, I don't. So regarding what the use of this facility would be, how would you handle any medical waste? [0:32:39, 0:32:41]: Etcetera that would not impact your neighbors. [0:32:41, 0:32:45]: Given the fact that are there there are private residences around you. [0:32:45, 0:32:48]: Um, it wouldn't affect the neighbors at all, sir. [0:32:48, 0:33:08]: I have three-sided fans on each side. And for my medical waste, I always dispose my medical from the pharmacy, or when the nurse comes around, they pick it up and what is expired, or I don't use. This is how I dispose my medication. I don't have any medical waste where people can. [0:33:08, 0:33:22]: you know, get into it or anybody's private um information being disposed. I have different ways, I have regulations over how to dispose medication on people's property. [0:33:23, 0:33:37]: Would there be any kind of uh regular and and bear with me, I'm I'm obviously not in this business, but would there be any kind of environmental health or safety regular checks on the facility to confirm that you're [0:33:38, 0:33:46]: Uh the patients' welfare and the the medical waste or any other there would not be. Those patients, all of them most likely is wheelchair down. [0:33:47, 0:33:50]: They cannot go anywhere if you don't take them anywhere. [0:33:51, 0:33:53]: I personally [0:33:53, 0:34:01]: Don't even wanna accommodate somebody that walks because when somebody walks, your eyes gotta be on them 24-7. [0:34:02, 0:34:05]: I mostly accommodate people that are wheelchair bound. [0:34:06, 0:34:12]: That is what I have been doing for four years. This is what I'm gonna continue to do if I have given the chance to do it again. [0:34:14, 0:34:22]: All right, I don't have any no more questions. Thank you. Thank you. Are there any other questions? Yes. Mr. Plancher? Go ahead, go ahead down there. [0:34:23, 0:34:28]: Um, thank you for giving me the opportunity to speak. I I have a issue with this uh [0:34:29, 0:34:46]: requirement because it seem as though all the uh requirements are not met in the rules and regulations and and I'm just looking at some of the information that the staff uh wrote up concerning this property. [0:34:47, 0:34:51]: And I uh so far I still haven't heard anything whether or not [0:34:52, 0:34:55]: Miss John has talked to the neighbors in the community. [0:34:55, 0:34:59]: I I d I haven't heard anything concerning that. [0:35:00, 0:35:05]: and then with staff remarks, I'm kinda concerned that [0:35:06, 0:35:16]: There wasn't uh planning and information presented to her, but I'm also listening to her about that she did get some of the requirements. [0:35:17, 0:35:19]: And from the staff [0:35:19, 0:35:22]: those requirements have not been met. [0:35:27, 0:35:31]: That's it. I'm finished. Thank you, sir. Mr. Planchet, please. [0:35:33, 0:35:45]: You had a question still? Yes, a couple of them. One one my first question is uh uh have you received uh I don't see any mention in your packet of complying with health department code. [0:35:45, 0:35:50]: And have you been certified by the health department to provide this kind of services in your home? [0:35:51, 0:36:11]: Yes, sir. I have the license. I have a CNE license. I have medication license. I have first aid CPR. So I am more than certified to do what I'm doing. Yeah, the health department's different. Also, is your home uh ADA compatible? You have room for people to bring in wheelchairs and turn wheelchairs in the hallway. [0:36:10, 0:36:17]: Yes, sir. And did I hear you say it was two story? No, it's uh ranch house. Okay. [0:36:18, 0:36:32]: with um two um four bedrooms upstairs and two downstairs. Two um I heard she said that I was gonna put two people in a room and um it requires um [0:36:33, 0:36:35]: Eighty square feet per person. [0:36:36, 0:36:42]: The only two rooms that are two people gonna be in is two master bedrooms. [0:36:43, 0:36:44]: One of them is [0:36:50, 0:36:54]: One of them is four hundred and sixteen square feet. [0:36:55, 0:36:56]: And the other one [0:36:56, 0:36:58]: I visit okay. [0:37:01, 0:37:02]: [2223.4, 2227.2]: The other one is free is um two two hundred and [0:37:07, 0:37:09]: Seventy two square feet. [0:37:09, 0:37:22]: The single bedrooms are one is a hundred and forty square feet and the other one is a hundred and twenty eight square feet. So all of the rooms are way above the required square feet. [0:37:26, 0:37:28]: You have any other questions, Mr. Planchet? [0:37:31, 0:37:39]: Okay. Mr. Mid? Yes, I have one more question. I'm sorry. So when we when you came before us last September, one of the concerns was the parking. [0:37:40, 0:37:43]: For the home, and I shi'er that now. [0:37:43, 0:37:52]: Several months later, there's still no consideration for resolving the parking situation. The parking, the reason why she was um concerned about the parking. [0:37:53, 0:37:56]: It because I just got the home, there was debris. [0:37:56, 0:38:01]: The p the first set of people who had the house didn't they didn't clean at all. [0:38:01, 0:38:05]: So there was a lot of debris making the space very small. [0:38:06, 0:38:14]: But I have cleared everything and I have pictures to show you that there is enough way enough space. [0:38:14, 0:38:16]: Yesterday I had a um [0:38:17, 0:38:20]: Big um truck from Home Depot delivered a washer for me. [0:38:21, 0:38:23]: They turn out the back of the house, the long trucks. [0:38:24, 0:38:28]: I just didn't my phone was there. I I was about to take a picture because I said I wanted to show it. [0:38:29, 0:38:30]: So you guys that [0:38:30, 0:38:31]: There is enough space. [0:38:32, 0:38:37]: And I took the pictures, I can pass it on to you where you can see for yourself. [0:38:37, 0:38:42]: There is and I can invite you all at my at the place to see with your own eyes. [0:38:43, 0:38:45]: There is in a space. [0:38:45, 0:38:51]: The backyard is very big. The size is very big. It is one point [0:38:51, 0:38:54]: four seven acres and all of it is cleaned. [0:38:56, 0:39:01]: If I can ask one more question. So in the course of a normal business day, how many cars would you expect? [0:39:02, 0:39:07]: They don't normally have a lot of cars. The nurse will come in sometimes once or twice a week. [0:39:08, 0:39:13]: This um aid will come in every day, sometimes some of them are sign. [0:39:13, 0:39:15]: Once or three times a week. [0:39:16, 0:39:22]: These are all the people. Family members, they come when they have time. Sometimes you see a family member. [0:39:23, 0:39:29]: Sometime once a month. Some of them come every week because everybody's working. That's the main reason they have them over there. [0:39:30, 0:39:31]: We don't have [0:39:31, 0:39:34]: any c congested traffic. We don't have any [0:39:35, 0:39:41]: six, seven cars at a c at a at a place at one time. Never before it has happened, not where I am. [0:39:41, 0:39:42]: Where I used to be, sorry. [0:39:43, 0:39:51]: I haven't seen it before, and I haven't heard of it before. It was the first time hearing of it. I'm saying it this is not a nursing home. [0:39:51, 0:40:00]: Why will there be congested traffic? Why will there be five, six, seven vehicles at one time? And if there is that five, six vehicles, there is enough space for them to pack. [0:40:01, 0:40:07]: At the back of the house, but next to the garage, there is enough space for everybody to buy. Nobody has to be on the street. [0:40:09, 0:40:09]: Okay. [0:40:09, 0:40:16]: Thank you. Thank you. [0:40:17, 0:40:30]: I will now open this case up for public hearing. Is there anyone who would like to speak in favor of the special use permit case SP dash twenty twenty four dash O three? You can ask questions or make comments. So if anyone would like to please speak in favor. [0:40:36, 0:40:44]: Is there anyone that would like to speak against the current special use permit case? Please, sir, make sure you sign a form here. Okay, bring it on up. [0:40:50, 0:40:51]: Yeah, you can give it to a stare. Mm-hmm. [0:40:55, 0:40:57]: Please state your name and address for us, please. [0:41:00, 0:41:04]: My name is Robert Schule. I live at two sixty f or [0:41:05, 0:41:08]: I live across the street, two fifty three Shields Road. [0:41:10, 0:41:25]: She just talked about a truck making a delivery the other day. The truck has to take the right-of-way, almost taking my mailbox out to get in the driveway. The driveway is not wide enough for that. The driveway is across from mine. She they had some trub shrubs removed. [0:41:25, 0:41:42]: A guy had a truck and a trailer. He had to come into my driveway to back up their driveway. There used to be a fence along the front of the property for years. I've been here at that property about twelve years. They just took that down. We had to take the fence down, part of it, so the guy could get out of the yard. [0:41:42, 0:41:43]: Um [0:41:44, 0:41:52]: In the news we've heard m people wandering off. I mean, she just said they were gonna be in wheelchairs, but we've heard of people wandering off elderly people and drowning in ponds. [0:41:54, 0:42:14]: There's a two and a half acre pond across the street between me and my neighbor's house that we share. There is a fence in part of the uh pond, but not all the way up my property. I'm concerned about somebody wandering off and drowning. Um my neighbor on the corner, his mom just around the corner off a flat rock. [0:42:13, 0:42:23]: rock went down in her backyard and slipped and fell and drowned in her pond a couple of months ago. Um that's one of my concerns. Um [0:42:24, 0:42:39]: She said it was a single level. There's two there's a basement in this house with the two bedrooms downstairs. My question was, she's gonna have staff. Is it how many people have to be on duty twenty four hours a day? [0:42:40, 0:42:40]: Um [0:42:41, 0:42:46]: ambulances, like I said, they come down the driveway, everything shines into my house and my bedroom. [0:42:47, 0:43:07]: Both our bedrooms are in the front facing the front. So we're gonna have the lights shining uh in there. We've already got a traffic issue on Shields. Uh I brought this up in another meeting while we were here with speeding. I've been here, I did a petition that went nowhere, been to Henry County Police before Stockbridge Police. [0:43:07, 0:43:10]: They put up the monitor, still nothing. [0:43:11, 0:43:28]: talk to the city of Stockbridge Police, we're still not having any issues, getting it resolved. They're going down the road at sixty, seventy miles an hour. There's a person who lives on Shields if you're heading towards 138 off of Davis. Before you get to the stop sign, he's on the left. He's got a grade job charger. [0:43:28, 0:43:31]: For some reason he just thinks it's a drag race. [0:43:31, 0:43:36]: I stopped by there and said something and was told my own business. I have grandchildren. [0:43:36, 0:43:38]: That are at my property. [0:43:38, 0:43:51]: I'm I don't know who else to talk to. I've asked about putting speed humps in to slow them down. We were told you can't do that. There's always already an issue. We just put all these streetlights up down through there. And I'm like, okay, this sounds good. Now not only are you gonna go down the road. [0:43:52, 0:43:55]: During the day fast, now they're gonna go down the road at night. [0:43:55, 0:43:58]: But we've already got some issues in that area. [0:43:58, 0:44:00]: I'm just concerned that [0:44:02, 0:44:11]: The other I went over and met her husband the day everything was closed. I went over, introduced myself, being a good neighbor. I said, man, this is a big house. [0:44:12, 0:44:14]: How many people are coming? Oh, just me and my wife. [0:44:15, 0:44:35]: Wow, okay. He never said anything about opening a business. He lied right to my face. And that is stings and it stuck with me. That they weren't up front and said this the other neighbors, they're upset about it. But they don't have the time or the nerve to come up here and [0:44:35, 0:44:54]: Say what needs to be said. This is a nice residential area, bunch of families. Um I brought up at the one meeting there was a place on Rockcorey that was vacant. It was a healthcare facility that was vacant, that was available for lease. And she's her passion. She says her pass is her passion. I understand that. That's fine. [0:44:55, 0:45:11]: Rent rent that place out. Whatever. Um, I'm just concerned with the lights coming in my house and ambulance, you know, if something happens, they're gonna be coming through there at what time of night. Um I don't think it's a good idea. [0:45:12, 0:45:15]: That's all I had to say. Thank you so much, sir. Thank you. [0:45:16, 0:45:18]: Is there anyone else that would like to speak against this case? [0:45:21, 0:45:27]: If not, I'll now close the public hearing. The board yes please. [0:45:30, 0:45:36]: Yelanda Barber, one nine seven Talon Place. I am a resident of City Council District Four. [0:45:36, 0:45:39]: Mossel, the city council district representative. [0:45:39, 0:45:49]: of this area. I've spoke with the applicant and also Mr Schultz. Um they're neighbors. They live right across the street from each other. [0:45:50, 0:45:50]: Um [0:45:51, 0:46:09]: I did have concerns in regards to the applicant's request to provide personal care for six residents based on the state code. So please consider that. I don't want to make a decision. [0:46:10, 0:46:26]: Um this is gonna come before the council uh couple of weeks, but I did wanna just for the record state that I am aware of this particular situation and that I've spoken both with the applicant and actually several of the homeowners who live in the area. [0:46:27, 0:46:28]: Um [0:46:29, 0:46:31]: That particular area [0:46:31, 0:46:32]: Was [0:46:32, 0:46:35]: recently annexed into the city in twenty twenty three. [0:46:36, 0:46:36]: Um [0:46:37, 0:46:37]: So [0:46:38, 0:46:46]: I would like to keep in line with what it has been. Um, there hasn't been any businesses um along that stretch of road. [0:46:46, 0:47:06]: It's been majority quiet residential development. I know Mr. Schultz has lived in his home for more than 20 years or so. Um so have the other homeowners who've contacted me. So I just wanted to express they do have concerns in regards to this, the lake across the stream. [0:47:06, 0:47:12]: from where this um special use will be issued if it is approved. [0:47:12, 0:47:13]: Um [0:47:13, 0:47:15]: There are concerns about that. [0:47:15, 0:47:17]: So just wanted to speak for the record. That's all. [0:47:18, 0:47:21]: Thank you so much. And thank you for joining us, Councilman Barber. [0:47:24, 0:47:37]: If there are no other persons that would like to speak on behalf of this case, I will now close the public hearing. The board will now vote on this case. Do I have a motion regarding special use permit case SP dash twenty twenty four dash O three? [0:47:39, 0:47:40]: Mr. Chairman. [0:47:40, 0:47:57]: Yes, sir. Uh all things considered, and I I don't doubt that uh she's very passionate about what she'd like to do. But given the fact that we've gone several months and it doesn't seem that a whole lot of progress has been made, I'm gonna make the motion that we deny uh SP twenty twenty four [0:47:59, 0:48:06]: Mr. Chairman, will you please let the requests for approval go first and then if nobody answers then take request to deny. [0:48:08, 0:48:11]: Well there's already been a motion on the floor, so if Mr. Middle recuses motion. [0:48:11, 0:48:21]: I will. Okay. Uh per Mr Plantin at the end he asked for the motion to be approved first. So is there a motion to approve? [0:48:25, 0:48:26]: Hearing none, [0:48:29, 0:48:38]: In in hearing none, uh Mr. Minn, will you would you like to move forward with your motion to Mr. Chairman, I'd like to make the motion to deny S P twenty twenty four [0:48:39, 0:48:43]: Oh three. Mr. Chairman, I second that. [0:48:43, 0:48:59]: There's a motion by Mr. Minn and a second by Mr. Planchton. Um all those in favor, please indicate by the sound of aye. Aye. Aye. Aye. Any opposed? So moved. S P dash twenty seven four dash O three is denied. [0:49:01, 0:49:12]: You're uh see see it on the record that there are four uh four in favor of the denial and one against, as Miss Walker wants the record to reflect she's against that d uh motion. [0:49:15, 0:49:33]: The next two item on items on tonight's agenda are the Comprehensive Plan Amendment Case CP-2025-02 and rezoning case RZ-2025-03, which are both for the same applicant and the same property. I will read them both into record. [0:49:34, 0:49:54]: After that, we'll have a joint presentation from staff and a joint public hearing of these two cases. Then the board will vote on each case separately. Comprehensive plan amendment case CP-2025-02. Properties located in Council District 4. Consideration for parcel 029-0101. [0:49:54, 0:50:14]: 11001, located between North Train Boulevard and Old Atlanta Road, south of Valley Hill Road, for the purpose of changing the property's future land use destination from low density mixed use to high density misuse to allow for the development of townhomes and office space. Applicant is Templar Development Group, LLC. The agent is Battle Law. [0:50:14, 0:50:25]: Property is located in land lot 90 of District 12 and it contains 9.90 more or less acres of land. The rezoning case, RZ-2025-03. [0:50:26, 0:50:46]: Consideration of a rezoning for the parcel stated previously located between North Terrier Lavard and Old Atlanta Road, south of Valley Hill Road for the purpose of rezoning the property from C three heavy commercial and PMU parkway mixed use overlay district to PUD Planned Unit Development Master Plan and PMU Parkway. [0:50:46, 0:51:03]: Mixed use. Overlay district to allow for the development of townhomes and office space. Uh applicant again is Templar Development. Agent is Battle Law. The property is located in lotland 90 of District 12 and it contains 90, 9.90 more or less acres. Uh I'll now allow for the staff to give the presentation. [0:51:05, 0:51:25]: Thank you, Chairman Williams, uh Commissioner and Staff. My name is Gordon Linton, Senior Planner for the City of Stockbridge. I'm here to present the case for CP 2502 and RZ 2503 for parcel number 029-010-1101 between North Harry Boulevard, Old Atlanta Roads. [0:51:25, 0:51:27]: And south of Valley Hill Road. [0:51:33, 0:51:53]: Case facts, uh as mentioned, the applicant is Templar Development LLC, with the agent being Battle Law PC. The owner is William B. Gilmore and Miriam D. M. Gilmore. As mentioned, the subject property is located between North Herring Boulevard and Old Atlanta Road, south of Valley Hill Road. [0:51:52, 0:52:04]: Subject property spans nine point nine acres and is currently zone C three, which is heavy commercial, and designated in the City of Stockbridge 24 comprehensive plan as low density mixed use. [0:52:09, 0:52:13]: This is the aerial photo of the property with the [0:52:15, 0:52:19]: Where where you see the pointer, that is the location of the uh subject property. [0:52:20, 0:52:24]: And below you have Walmart and the uh surrounding subdivisions. [0:52:29, 0:52:31]: This is the era photo with a side plan. [0:52:42, 0:52:45]: This is the survey of the property that was uh submitted. [0:52:52, 0:53:02]: And this is the when we did the site visit on April second, twenty twenty five, when we posted the signs. The sign is here and then further to the south is the Stockbridge North Shopping Plaza. [0:53:10, 0:53:22]: And this is another picture of the uh site the signs that was posted that day. And further down is the Stockbridge North Plaza and over here is the site. And note that they are also widening the uh roads in the area. [0:53:30, 0:53:32]: Development information. [0:53:39, 0:53:59]: Templar Development is proposing a 9.90-acre mixed-use residential community with office space on the western side of North Herring Boulevard. The project features 98 attached townhomes with bricks exterior and two-car garages. The key infrastructure elements include a stormwater, [0:53:59, 0:54:19]: Management facility and lift station by Clay County, Water Authority, a hammerhead turnaround on Otal Lana Road to improve the emergency vehicle access, a ten foot concrete sidewalk along State Route 42 and US Highway 23 for pedestrian safety. The community amenities include an office. [0:54:19, 0:54:39]: Building with eight parking spaces, five-foot mulch walking walking trail, a top lock for families, and a dog park. And the home ranges from 1200 to 1500 square feet with the following setbacks: a 10-foot front yard setback, five-foot side yard setbacks along the exterior, and a 10-foot separate. [0:54:39, 0:54:40]: Yeah. [0:54:45, 0:54:45]: Mm-hmm. [0:54:53, 0:54:55]: So this is the site. [0:54:56, 0:54:59]: The side plan shown? Uh let's see. [0:55:01, 0:55:01]: Okay. [0:55:02, 0:55:11]: So as you can see, this is the Dow Park. This is the top lot uh where my mouse is. This is the stormwater management facility. [0:55:13, 0:55:29]: This is the proposed lift station. And this is the ten foot sidewalk uh along State Route 23. Uh this is the office space building. And they also have the hammerhead turnaround for emergency access vehicle only on Old Orlanta Road. [0:55:45, 0:55:48]: This is the development data of the proposed development. [0:55:55, 0:55:58]: These are the elevations of the proposed development as well. [0:56:14, 0:56:17]: Moving on to CP twenty five-0 two. [0:56:18, 0:56:30]: As mentioned, the applicant's request is to change the future land use density from low density mixed use to high density mixed use to allow for a mixed use development that will include nine eight units and office space. [0:56:32, 0:56:37]: This is the comprehensive plan which uh talks about the high density mix use. [0:56:43, 0:56:54]: And the surrounding land use designation, the vicinity of the area is mostly low density mixed use, low density residential, medium density residential, and high density residential. [0:56:55, 0:56:57]: And this is the future land use map. [0:57:02, 0:57:05]: With my with the pointer showing the location of the property. [0:57:11, 0:57:30]: And this is the the range as far as the densities. Uh is nine point nine units per acre. However, there are five seventy six Davis Road, which with six units per acre, and the Victory Worship Center, which has fifty six units with five point six five units per acre. So overall it meets the compatibility of the area. [0:57:34, 0:57:36]: This is the surrounding land use density map. [0:57:43, 0:58:03]: And then staff analysis. The key points to from the staff analysis is that the PUD zoning is compatible with all the future land use designations, including the proposed high density mixed use. The current low density mixed use designation only allows up to 3.9 units per acre. The proposed 9.9 units per acre exceeds this. [0:58:03, 0:58:06]: Which requires a change to high density mix use? [0:58:07, 0:58:16]: And rezoning to PUD allows the site to accommodate a walkable, mixed use neighborhood while maintaining consistent adjacent uses like Valley Hill Station. [0:58:22, 0:58:25]: And therefore staff recommends approval for the comp plan. [0:58:30, 0:58:33]: Moving on to the resulting for RZ twenty five dash zero three. [0:58:37, 0:58:46]: As mentioned, the applicant's request is to rezone from C three and the PMU to PUD to allow for the development of the townhomes and office space. [0:58:48, 0:59:08]: This is the surrounding zoning property information. The vicinity of the proposed development is mostly residential and commercial, with the following zoning districts: PUD, Pan Union Development, MFR, which is multifamily residential, C3, which is heavy commercial, C2, which is general commercial, RR rural residential, [0:59:08, 0:59:14]: Residential, SR, Suburban Residential, and C C R, which is City Center Residential. [0:59:16, 0:59:20]: This is the zoning map of the property with my pointer showing the uh location. [0:59:27, 0:59:31]: This is the overlay map showing the property in the uh Parkway mixed use overlay district. [0:59:43, 1:00:00]: In the staff analysis, as far as the key points, the proposed development aligns with the Stockbridge long-term goals for housing diversity, walkability, and flexible development. The project is designed to serve as a thoughtful transition between commercial and residential zones. [1:00:02, 1:00:07]: The development is well supported by existing infrastructure and designed to minimize traffic concerns. [1:00:12, 1:00:32]: And the fourth point is that the property is currently zone C three heavy commercial, which allows for automotive services, gas station, and self-storage. However, the area is already saturated with auto-related businesses, including Greenway, Auto Parts, Auto Tech Customs, Tire Solutions, and Fabulous Used Car. [1:00:32, 1:00:49]: Another gas station, another auto shop or a self-storage facility will contribute to traffic congestion and limited economic growth, resulting to PUD will encourage walkability, reduce congestion, promote a live workplay environment, and support the city long-term economic goals. [1:00:59, 1:01:19]: And therefore, staff recommends approval with the following conditions. The subject property shall be developed according to a revised site plan, which was prepared by Atwell LLC on April 7, 2025. The title is Resonance Site Plan North Henry Boulevard Track. Two, the proposed mixed use development shall adhere to the architectural renderings. [1:01:19, 1:01:39]: Submitted with the application on March 10th, including the use of brick as the exterior material. 3. The developer shall install black street light poles. 4. Decorative street lights shall be installed along the frontage of North Henry Boulevard. 5. Fly cameras shall be installed at the entrance of the mixed-use development. 6. [1:01:39, 1:01:59]: The developers shall adhere to the MFR development standards found in Section 2.4 of the Stock Bridge Unified Code. In addition, the developers shall adhere to the Parkway Mix use overlay district standards found in Section 2.52E of the Stock Bridge Unified Development Code. Seven, the developers shall include one or more central transfer structure. [1:01:59, 1:02:19]: Facility. Eight, a mandatory tonehome HOA shall be established. Nine, the developers shall comply with all the Clay and County Water Authority, state EPD and federal EPA requirements to provide water and cylinder facilities for the mixed use development. 10. Access to old Atlanta roads shall be restricted. [1:02:19, 1:02:28]: To emergency vehicles only, a gate with a knocks box shall be installed to prevent general traffic flow while ensuring emergency access. [1:02:28, 1:02:45]: As required by the fire marshal. Eleven, the HOA shall occupy no more than fifty percent of the office building. And twelve, a twenty five foot buffer shall be established along the northern, southern, and eastern portion of the subject property. And that concludes my presentation. [1:02:46, 1:03:06]: Thank you, Gordon. Um I have two questions specifically uh in regards to the staff recommendation of approval. Uh what factors specifically led well I'm not against it, it is a majority residential area, what factors led to uh you all to conclude that development would be compatible with the characters like the with the [1:03:06, 1:03:26]: uh building and construction already of the area. And then uh let me let me add to my second question. Um, what specific infrastructure evaluations did you all conduct uh for us to ensure that the proposed high-density mixed-use development can be supported without the overburdening of existing city services? [1:03:26, 1:03:33]: Uh, I'm not sure if you're [1:03:34, 1:03:54]: Well first of all, um we examined we contrasted the um the applicant's proposal against the criteria criteria that's and standards that are in the um in the P in the UDC and we did an objective analysis and we reached those conclusions. And second, as far as infrastructure um [1:03:54, 1:04:00]: They they received a letter from uh Clayton County Water Authority saying that they have the capacity. [1:04:03, 1:04:22]: Mr. Chairman, I'd also like to make mention that we are here for just these two items. One aligning the property with the land use plan and the second is rezoning it accordingly. We're not here looking at any development plan that we're needing to approve or disapprove. Absolutely. So we're just looking at the land use update and the rezoning. [1:04:22, 1:04:26]: Yes, sir. Ms. Walker. Mr. Chair. Uh yes. [1:04:26, 1:04:42]: thing. I'm not I may not be well versed in this area, but my question is, uh, you know, I don't know if anybody can answer this, but what what was the inspiration behind, you know, moving from low density to to high density? [1:04:43, 1:05:03]: So currently the low deck. And let me just fin uh I'm sorry. Uh the reason the reason being because is because I used to live in another county and uh a few years ago um when I when I w was in Fulton County, um there was a land that was being developed. [1:05:03, 1:05:12]: And there was a vast majority of of of trees cut down and all of a sudden development just stopped. [1:05:12, 1:05:25]: And so I'm just curious as to, you know, is is is something like that gonna happen in this area. I want to know the like the inspiration be behind the low moving from low density to high density. [1:05:26, 1:05:42]: So currently it's zone uh low density mix use, which is c incompatible with their requested um mix with their requested future land use, which is high density mixed use. So therefore they have to um re Yeah, they have to change the future land use designation. [1:05:42, 1:06:02]: Yeah, I I understand. I was just saying like can we just you know why couldn't they just work with what they already have with the low density? That's I was just concerned about that with regard to the project probably wouldn't be feasible. So we'll limit the amount of units they can have on the property to around to a maximum of three point nine per unit. [1:06:02, 1:06:20]: Uh and uh we have in code as it relates to the trees, the question about the trees, there is a tree um replacement plan uh that has to be submitted during the LDP phase, the land disturbance permit phase to address the cutting down of trees. [1:06:21, 1:06:21]: Okay. [1:06:22, 1:06:23]: Okay, thank you. [1:06:24, 1:06:26]: Thank you. Are there any other questions for staff on the board? [1:06:27, 1:06:29]: Yes, Mr. Chairman. Yes, sir. I have one. [1:06:29, 1:06:37]: Um scoring I don't know is y the question I have might be better suited for the applicant. So is the applicant here this evening? Okay. Yes. All right, I'll I'll wait. Thank you. [1:06:38, 1:06:42]: At this time I'll allow for the applicant to come and uh speak or give his presentation. [1:06:46, 1:06:47]: There you go. [1:06:57, 1:07:14]: Good evening, Michelle. Battle with Battle Law, 3562, Habersham at North Lake, Tucker, Georgia, three zero zero eight four. I'll try not to be too redundant, but there are some things I'd like to point out. How much time do I have? Ten minutes. Ten minutes, okay. Um but we got two applications. I don't get twice as much time. [1:07:15, 1:07:35]: Okay, thank you. I appreciate that. Not that I might need it, but I figure, you know. Um so as indicated by staff, um this property it was recently annexed into the city of Stockbridge and is zone C three um and was incorporated into um was and as it was in unincorporated Henry County. [1:07:35, 1:07:55]: The overlay district, being the parkway mixed use, does allow up to 45 units per acre, and that is what covers this area and is a part of that overlay district. And the applicant is seeking to develop, and I apologize on this slide, I had the wrong number, but 98 units at a density of 9.9 units per acre. [1:07:55, 1:07:55]: Yeah. [1:07:56, 1:08:16]: The future land use map is an interesting challenge because right now the low density mixed use designation is not consistent with the Parkway mixed use district. Um if you look at the um zoning designations that are allowed under low density mixed use, um you will see [1:08:16, 1:08:36]: That it indicates that Downtown Village Overlay District, O and I, and C1 are the districts that are consistent with the low density mixed juice, which means that the parkway designation, the overlay district, is not consistent. [1:08:36, 1:08:56]: And our PUD request is not consistent. And therefore the low density mixed use designation simply is not consistent with the overlay district that has been placed over this district. So in fact, if you were trying to rezone or develop right now under even the C3. [1:08:56, 1:09:15]: The C3 is not consistent with the low density mixed use. And so that is why we are seeking a change in the land use designation to high density, which is in fact consistent with the parkway mixed use overlay district designation for the property. So once again. [1:09:17, 1:09:37]: The current zoning and the overlay district both are inconsistent with the current land use designation for the property. And typically, particularly with regards to the parkway mixed use, that is the overlay district that really is a guiding force for the major. [1:09:37, 1:09:57]: Major intersections throughout the count um throughout the city that was put in place in order to allow for growth and development and mixed use along those corridors. Therefore, in my opinion, that should supersede the underlying land use that is currently there that is not consistent. This site located south. [1:09:57, 1:10:17]: Of Valley Hill Road along North Henry is a corridor that has not seen much new development. In fact, even the residential communities that are surrounding it are older residential communities. So there's been no real new development in this area along this part of the corridor in quite some time, and is a corridor. [1:10:17, 1:10:37]: Corridor that quite honestly could use some uplift and facelift. If you've driven down that corridor, you can see here we've got what looks like a very car-centric oriented use on the other side, used car and as well as other [1:10:37, 1:10:55]: Non residential uses that are along that corridor that quite honestly are older in use, more auto-centric, and really could use an influx of new development to come in and uplift this particular area of the city. [1:10:57, 1:11:17]: We know that GDOT is currently doing the road widening as staff has already indicated. From the perspective of traffic along here, I actually have before you the GDOT information concerning the road improvements that will be directly in front of this property. There will be a median strip and a left turn lane. [1:11:17, 1:11:36]: So you will not be able to turn left into this community. You will have to go up once you turn right in. It'll be a right in, right out. You will be able to go to the light. And then there will be a left turn, kind of U-turn lane that you will be able to make to go back the other direction on North Henry Boulevard. [1:11:40, 1:12:00]: In terms of the site plan, again, we've got 98 fee simple townhome units. Minimum for the office space is 1,296 square feet. That building's 36 by 36. It is quite possible that it may be slightly bigger, depending upon kind of final decisions. [1:11:59, 1:12:19]: With regards to that building, but that is certainly the minimum size. The intent here with that building, um, well, I'll talk about that in a minute, but the building itself um will be an office building to be used on the site. And then there's also the two points of entry, um, which staff has also made reference to, one off of um north. [1:12:19, 1:12:39]: Henry and the other off of Old Atlanta Road, which is a partially opened street. And we'll talk a little bit more about that as well. Again, we're at 9.9 units per acre on this site. And we believe that that is reasonable, particularly when looking again at the parkway mixed use, which allows for up to 40. [1:12:39, 1:12:59]: Five units per acre. We're not even attempting to get that far. And what that really means is that when you're at that high of a density, you're talking about apartments. We believe that putting in fee simple home ownership along this corridor to keep eyes on the street and eyes within this part of um [1:12:59, 1:13:19]: an area that is truly needing of redevelopment is better um as opposed to putting some type of single family detached home, which really would make no sense on this corridor. No one um I think uh most of the um real estate uh agents and brokers will tell you don't buy a house on a double, you know, single family [1:13:19, 1:13:22]: det detached home on a double lane highway. [1:13:23, 1:13:43]: I believe that kind of holds for some type of single family detached type product that would be similar to the other summer um single family detached product in the area. We think that this is kind of the middle ground. Instead of having multifamily here, that we are encouraging home ownership, these units will be very nice units. [1:13:43, 1:14:03]: And I think you'll see that as we continue through this process. The office building will be for small businesses that don't require a lot of parking. We know that the HOA will own the building. They will be able to utilize no more than 50% of the space. So if they want to have a community meeting or things of that. [1:14:03, 1:14:23]: nature they'll be able to do that within the space but the rest of the space they will be able to rent out and that really allows the HOA to have you know some more investment in this community. Our hope is that maybe one or two of the residents that live within this community will actually utilize that office space for themselves and be able to grow their businesses and start businesses a [1:14:22, 1:14:26]: Along this corridor that will also contribute to the uplift of this area. [1:14:28, 1:14:48]: When we look at the site data, we've got minimum unit sizes at 1,400 square feet with three to four bedrooms, parking spaces. We've got two car garages with the two parking spaces in front, and these units we anticipate will be in the low to mid 300s, which means that the average person that's qualifying for those. [1:14:48, 1:14:50]: [4490.1, 4510.1]: There would be a young professional, might be someone who's single that really doesn't have any kids. That's kind of the folks that this project will be marketed to. It's not really a major kid-oriented type environment. Those who probably want to spend$350,000 on a unit would be able to probably go buy a house for that. [1:15:10, 1:15:30]: If they need a bigger space for their families. So this is really typically for more empty nesters. Our amenities include the tot lot, a dog park, and a mulch walking trail that connects into the sidewalk system, as we have shown here on the site plan. And then with regards to the unopened park. [1:15:29, 1:15:38]: Portion of Old Atlanta Road that normally would have uh connected down to um I can never can remember the name of the street, I think it's Valley. [1:15:40, 1:16:00]: Valley Hill, sorry. Um and having driven out there, uh you don't see any evidence of old uh Atlanta Road when you go down Valley Hill. You only see it if you come down through the back um street, and that's why I think it is appropriate as staff has indicated for that to be a knocks box only, but that does allow [1:16:00, 1:16:20]: If there's any type of congestion along North Henry Boulevard, for cars to be um for um fire and safety vehicles to be able to come through that back entrance, and that's what's most important is that if anything ever happened along that stretch, they would still be able to access. You can see here from this plan that um there's an asphalt um [1:16:20, 1:16:40]: Roundabout at the very back end that back ends onto our property. So that street does not go beyond that. We will be um putting that into more of a T foun uh formation you'll see here where that will allow the emergency vehicles to be able to come in and come out of that space and putting the Knox box. [1:16:40, 1:17:00]: There would not be a problem. The other thing, though, that I think is important to see is that there is basically almost a buffer between us and the rear of the homes on the other side. So we're looking at about 40 feet of width between us and those homes to the east of [1:17:00, 1:17:20]: Of the site, in addition to the roughly 14 feet of setback that we have on or buffer that we have along the perimeter of this property. So we're talking about basically over 40 feet, 50 feet of distance between us. My math is bad. I think that's 55. [1:17:19, 1:17:29]: between us and um the rear of the um other um homes, the single family detached homes on the other side. In terms of visuals. [1:17:30, 1:17:50]: This is a great product that we're bringing in. Templar Development is a newer company with folks who have been in this business for over 30 years. We've got Jay Knife here with us. They call Knife Homes. They have done a ton of developments over the last 30 plus years. They are local developers. [1:17:50, 1:18:10]: And so they are very committed to this area in bringing in a quality product. When you look at the townhome units that are being proposed, they've come with more decorative garages, if that's flavored that the city would like with both a stone or brick textures on the majority with the more. [1:18:09, 1:18:29]: We've got a couple of different looks, and depending upon what the land preference and style is. We also have some other units that can also be incorporated with modifications in the garage door design if that's something that the city would like. But once again, um [1:18:29, 1:18:40]: trying to use a more architecture that incorporates different textures with regards to the size of the building. [1:18:42, 1:19:02]: So once again, we think that this is an appropriate location. They're not far from the bar. This is a very kind of suburban area along this part of the corridor. We want to see growth and development and improvement along this part. As you said, it's just recently been brought into the city. [1:19:02, 1:19:15]: We feel like this is a good first step in terms of bringing new development along this portion of the corridor. We'd be happy to answer any questions that you may have. And again, we do have a representative from Templar here with us. [1:19:16, 1:19:17]: Like your basis. [1:19:18, 1:19:24]: Thank you so much, Ms. Battle. Are there any questions from the commission to the applicant? [1:19:24, 1:19:35]: Mr. Chair, I have one. Uh is there a time frame where this project is gonna be completed? Yes. Oh Jay, you wanna I'll let um Jay Knight come up. [1:19:37, 1:19:37]: Yeah. [1:19:37, 1:19:57]: I'm sorry, what was the question? My name is Jay Knight with uh Knight Homes and Templar Development. Yes, is there is there a time frame where this will be completed and and also um are you able to share like the the makeup of the what these units will be made up of, like hardywood and plank? [1:19:57, 1:20:15]: Sure. Thank you. I d I'd sitting here, I was my first zoning meeting in Stockbridge was a little over forty years ago. And my father and I were uh zoning a piece of property on Flippin' Road. And I think I was trying to count be [1:20:15, 1:20:35]: probably built well over a thousand homes in this probably within two miles of uh this this location. Um the the neighborhood if we if we are successful with our zoning, which would be another during this next month, we would be about four months before we up [1:20:35, 1:20:55]: can file our engineering for a land disturbance permit. A land disturbance permit, although municipalities we would love for them to turn them around in 90 days, some they're taking as long as nine months. So um so that's 13, 14 months. It'll take about a year to put it on the ground. So [1:20:54, 1:21:14]: So that's 26 months. Then it will take six months to get home standing, ready to sell and occupy. So we're at 32 months, almost three years before anybody will move in there. Then we will be, if we're fortunate, we would sell about three. [1:21:14, 1:21:24]: three homes a month. And that puts us another three years. So from today till complete build out, we would think would be around six years. [1:21:26, 1:21:46]: The the the homes themselves all feature predominant um uh brick on the on the fronts. We use painted siding, um hardy type siding or cement fiber siding. Uh I had put together night homes sold to DRB homes and I [1:21:46, 1:22:06]: put together that uh Diamante project on East Atlanta Road. It was 195 homes. As a matter of fact, we just completed Templar. We went we just finished building the swim uh playground for them if you've seen that neighborhood. And it looks fantastic. Um we we will have Hardy here. [1:22:06, 1:22:26]: We have um we believe this is a wonderful location for this neighborhood. If you, in addition to everything we did here in in Stockbridge through the years, if you continued on up the highway towards 675, you'd pass another neighborhood that we did almost 30 years ago called Biscan. [1:22:26, 1:22:46]: Point. And that one is in Rex, just barely in clay into Clayton County. Very successful, and it really helped set the tone there because adjacent to that neighborhood was a bunch of um of kind of an assortment of lots that were never built. Over here, across the street from us here, we have a [1:22:46, 1:23:06]: a um a kind of a junkyard parts place and behind that is this this massive old uh uh mobile home community that's been there forever. It's here before we were here forty years ago. And so we're confident this is an upgrade to the area. We're very confident in the area. We've [1:23:06, 1:23:26]: Uh we're if if you have Horton Breez on in one, DR's not DR Horton's not gonna come talk to you and and um and Mr. Pulti's not coming, Mr. Lenar is not coming, but we are here and we compete with all those folks um uh easily and successfully. [1:23:26, 1:23:37]: And we're here. Uh there's uh we've been my business partner is a Henry County resident and um and we've been around this area for years. Okay. [1:23:37, 1:23:50]: Good job. Thank you. And last question, is it safe to say this project is going to take six years, or is it safe to say uh the price is gonna be increased drastically? [1:23:50, 1:24:10]: I'd hate that, uh, but it's probably safe to say. The reason one thing, when we started building in Stockbridge years ago, there were large tracts of land to build. When we did North Bridge Station, it was close to a hundred acres. That was in 1985. Around 1990, we did North Wind at the corner of uh Walt Stevens Road. [1:24:10, 1:24:30]: Road and Flippin', that was over 100 acres. We did Glen Addy over on Tye Street, that was about an 80-acre site. Diamante was a large site. We did Pine Grove on Valley Hill Road over there. That was about a 90-acre site. The truth of the matter is, last [1:24:30, 1:24:50]: Land cost hasn't changed that much in the last 30 years. But what has happened is the piece of land that are available in successful cities like Stockbridge have gotten smaller and smaller because people like me have bought all the big tracks through the years. And so if we wanted to do a detaxed community on this site, one, the development costs are one of [1:24:50, 1:25:10]: these name these houses have to be over$300,000. If we were to try to do a detached community on nine acres, one, you wouldn't do it. There was there you might get 20, 20 building sites on it. It just wouldn't work. There's no point in even trying to make that work. In addition, [1:25:10, 1:25:30]: Though, let's say you wanted to do that, your land cost would be thirty, forty thousand dollars of land, but your development cost to do that much detached the big frontages that you have to do, that would be almost ninety thousand dollars. So now you're at$120,000 just for that part of the lot that has to transfer. [1:25:30, 1:25:50]: to a I'm sorry for this economics lesson, but man, it helped me when I heard it. So now we're at$90,000. There's a there's a transfer to the builder. When the the the development developer goes to the builder, it's got about 30% margin. So we're at$90,000, divide that by 0.7. Now we're at a$130,000 [1:25:50, 1:25:50]: Yeah. [1:25:51, 1:26:11]: And so what we would need, uh, and I think y'all probably are familiar with the 20% rule, so you want your building lot to occupy twenty percent of your retail sales price. Well, if we're on a hundred thirty thousand dollar lot, what would need to be economically feasible would be a six hundred fifty-thousand dollar [1:26:11, 1:26:31]: Our house on Highway 42 on a detached lot. I I cannot imagine that succeeding. And so what we believe will succeed is a, I mean, 300, these people are gonna have to make a household incomes over$80,000 apiece. So that's significant. [1:26:31, 1:26:42]: And we're gonna do it great. It's gonna be a great job. Um, it's gonna stand out and it's gonna be a wonderful uh gateway as you're coming south on 42 as opposed to what's there right now. [1:26:44, 1:26:47]: Are there any questions from the board members? Mr. Plant? [1:26:50, 1:26:51]: Go ahead, sir. [1:26:52, 1:27:07]: Oh, um I know we're not here to vote on your development project today, but I'll just for my edification, the gr the buffer zone you're having between this development, proposed development, and th th the other homes back there. Is that gonna be a green space or wooded space? [1:27:08, 1:27:28]: So um that will be green space. I've got it up on the board now. Um there will be fourteen inches roughly of green space. Then you've got the rear yard for that unit before you actually get to the unit itself. Um and then on the other side um we've got um some park area, dog park area when we get um first. [1:27:28, 1:27:48]: Further down onto the site. So some of the residents on the other side all they're gonna see is that continued green strip where the unopen road is at. On the other side of that will be some more grass and some improvement, some amenity. [1:27:48, 1:28:08]: area on the far end of the project and then you'll have the uh Knox box and the little street entrance on the other far corner and that will be it. And so they they will still be very protected. I don't see that the city has any incentive to reopen um old national. We we in fact check to see whether or not it had [1:28:08, 1:28:16]: formally been abandoned and that may be something that um might be pursued if the city is interested in in in doing that. Okay. Thank you. [1:28:17, 1:28:18]: Mr. Batman. [1:28:20, 1:28:40]: Yeah. Um so and maybe I'm crossing a line here, so I want to be very careful. So there's quite a bit of property available to the north as well. This seems like a very small slice of all the available property. So is there consideration for future acquisition of the property to expand this? We have we have [1:28:40, 1:28:45]: approach the owners of that property and they have no plans to sell. [1:28:45, 1:28:51]: Uh but if that were to be available, certainly I would I would like to think we would be available to pursue it. [1:28:52, 1:29:07]: And one last question, I'm sorry. So I'm I'm I live very close to this. So I'm intimate I said I I live very close to this area. So I'm intimately familiar um with this piece of property. So just from a visual [1:29:09, 1:29:13]: Our ninety eight homes, uh quite a bit of [1:29:14, 1:29:26]: shall I say, um, property to be putting on this nine point plus acres, and roads and parking for any visitors, etcetera. [1:29:27, 1:29:36]: Parking exceeds the s standards fairly significantly. And [1:29:39, 1:29:45]: Y no, not by the not by density standards. We work all over the southeast. Okay. And [1:29:46, 1:30:06]: That's just not how it considered h I think your own high density called for up to forty forty five units, Bring. I mean, your system only calls high density for you all this twenty I think it's only twenty units, um, even though the parkway overlay allows up to forty-five. I'm not sure um how they're characterizing that for your [1:30:06, 1:30:12]: high density, but you all your high is other people's medium, truthfully. [1:30:13, 1:30:28]: So so no, I don't I don't think that in our s we have had a lot of success in this area. So we're kinda we've we we've understood the market for forty years. I th I I'm confident this is the right that this is a will be a successful project. Um [1:30:29, 1:30:31]: I don't know beyond that what to say. [1:30:32, 1:30:49]: No, I and and I apologize. I mean from a rendering perspective it just looks like a lot to me. It is. It I think that the thing to keep in mind though is that when you look at what the parkway overlay district encourages when it comes to density. [1:30:49, 1:31:09]: Um it is leaning, it's bending towards a more multi-family type product, which could bring even more density. We didn't come in asking for that multi-family type product. Um, particularly uh a lot of people when they think of mixed use, they always think of you know apartments above retail or something. [1:31:09, 1:31:29]: type of flats above a retail. But in order to make those kind of projects work, you really have to pack in the density to make it make any sense. And so we believe that this is again kind of that middle ground where we're not oversaturating by putting that kind of multifamily type product [1:31:29, 1:31:49]: or coming forward with a multifamily type product, even if we did it at the density we have now, you're still, you know, it's just the utilization of the ground area that we're looking at and how it's still walkable, it's still attractive to those who want to live in that style. [1:31:49, 1:31:51]: Everybody doesn't like a town home. [1:31:51, 1:32:11]: Um but there are many people, there are many people who are out here buying town homes now. That's a lifestyle choice. For those who want a single family detach, that's great. For those who want to live in an apartment, that's fine. For those who want a town home, there should be that diversity of product. And we don't really see that over in this immediate corridor. But we do believe that this is appropriate, particularly [1:32:11, 1:32:14]: when you're on what is getting ready to be a four lane highway. [1:32:16, 1:32:36]: And and one last question, I'm sorry. Um and I know we're here to talk about the the rezoning specifically, but I do I am interested from a home ownership perspective, are there any controls on and I'm pardon me for being ignorant of this fact, but are there any controls over leasing that these will be strictly purchased homes and not leased so by [1:32:36, 1:32:54]: any means. We we are okay with having a rental restriction. I'm not sure if um staff I can't remember w what the conditions were, but I thought I saw one um with regards to a rental restriction, but we are um open to that if that's uh desirable. Okay. Ten percent. Ten percent. [1:32:55, 1:32:59]: All right, that's that's it. Thank you. Okay, I have a few questions. Um [1:33:00, 1:33:20]: One let and it's some are gonna be like, you know, kind of fast rounds, so just bear with me. But considering the proposed density for the nine point nine units per acre, more or less, um, and s which far exceeds the nearby residential uh densities that are typically what one to two point eight acres per acre. Um, how I guess with this development maintain the [1:33:20, 1:33:27]: compatibility and minimize the disruption uh between the adjacent lower density neighborhoods like the Valley Hill station. [1:33:28, 1:33:48]: Well, that's why I was making a point about the buffer. So we do have that street that provides some buffering between us. Um this is right now a commercial corridor. How do you provide that with what's there now? I mean, when we look at the C three zoning district and what uses could go there, I think that this use is much more [1:33:48, 1:34:05]: um appropriate between us and the adjacent um residential community. Those are older communities. This provides a transition into the more heavier commercial uses on the other side of the street. [1:34:05, 1:34:25]: That is, in my opinion, good planning because you never I think there's always a challenge when you have more intense commercial uses immediately abutting residential uses on the other side. They've been living with that for a very long time. We don't have real access into we don't have any access into their community. [1:34:25, 1:34:45]: Um this community is fronting on a um minor arterial road whereas their homes are fronting on local roads. So they will continue to live their lives exactly the way they're living them. Um we will have buffering between the two of us and these units will be facing onto this um [1:34:45, 1:34:54]: four lane highway that will allow for the traffic that this project will generate to be handled and not be a burden on the rest of that community. [1:34:55, 1:35:12]: So the only reason I ask is'cause I'm trying to wear, you know, the hat of a commissioner and then as a community neighbor,'cause I've also lived in that that neighborhood, I know for a fact that the city is kinda upside down when it comes down to our financial aspect where the residents are paying more of the taxes instead of the commercial. Um and so I [1:35:13, 1:35:33]: Again, I I'm just trying to think, you know, future wise. One, I know you put on the uh slide already the the tow junk it's a junkyard. It's not even like a tow a car shop, it's a it's a junkyard. So I mean who one, who wants to live across from a junkyard? But two, I would definitely not directly across from it. It's kind of cataporned but nonetheless. [1:35:33, 1:35:37]: Um I I hear what you're saying. I think that um [1:35:40, 1:35:50]: Right now this property at zone C three is also not in alignment. Somebody could come in, you know, if they wanted and and build on it tomorrow without having to come before this board. This area is in transition. [1:35:51, 1:35:55]: And in order for it to transition, in my opinion. [1:35:55, 1:35:58]: Um and what we have seen over years is that [1:35:58, 1:36:18]: The residential coming into a corridor like this jump starts the process. When other businesses see that money is being invested, particularly by homeowners coming into a corridor and trying to help move it in a different direction because they have the socioeconomic power to do so. Um [1:36:18, 1:36:22]: there may be an opportunity for a um [1:36:23, 1:36:43]: Uh cafe or a different type of restaurant to go there as opposed to more auto-centric type uses like um the junkyard across the street. Um the hope is that at some point somebody will offer that junkyard enough money that they'll leave. Um same thing for some of the other um businesses that are not really in alignment. [1:36:43, 1:37:03]: With that Parkway overlay district. The whole point, I assume, of the overlay district is to help transition that area into something different than what it is, and to make it more walkable, to make it more attractive visually as well to the residents who live within that area. [1:37:03, 1:37:15]: And so we're trying to bring more homeowners along that corridor to say, hey, we're here and and please come and join us along this corridor, as opposed to leaving it looking and being the way that it is today. [1:37:15, 1:37:35]: Well that kinda goes back to what I was saying. As the my concern is not of the residents being across, but I'm again the taxpayers in the city are paying the majority of and I know I'm not they'll be paying as well. At three hundred and fifty thousand dollars, they'll be paying too. So okay, remind me, what are the what are the uh feat? What's the feat of the sidewalks for the [1:37:37, 1:37:45]: Like did y'all did I tell us that? Um I know we're not we are compliant with what the city requires. I believe there's six foot wide sidewalks, but [1:37:46, 1:37:57]: Uh ten feet along the frontage and then within the interior the six feet. Awesome. And then uh and thank you. Any other I I have another question, but I'll go to staff. Any questions for the board members? [1:37:58, 1:38:00]: Okay, thank you so much. Thank you. [1:38:02, 1:38:13]: And then uh staff, while they why before I open the public hearing, let me ask with all with these additional residents, if it is approved, would that go against the city's code for assembly facilities? [1:38:14, 1:38:19]: Would it go against the code for assembly facilities with the additional residents coming in with this development? [1:38:21, 1:38:21]: Okay. [1:38:22, 1:38:42]: All right. Well, this is a public hearing. Um, so I will now open this public hearing up. If you are in favor um and you would like to speak in favor of uh the comprehensive plan amendment case CP-2025-02 and or the rezoning case RZ-2025-03, uh please fill out the form and you may come up now if you are in favor. [1:38:42, 1:38:42]: Favor. [1:38:46, 1:38:58]: All right. Hearing and seeking none. If if there is there anyone uh who would like to speak against the current rezoning and comprehensive plan case, uh please make sure you fill out a form and we have the floor now. Please, ma'am. [1:39:03, 1:39:06]: Yes. You can fill it out after or give it to staff if you'd like. [1:39:07, 1:39:09]: Please state your name and address for us. [1:39:12, 1:39:30]: Gwen Mack, three seven seven Grove Hill Drive, Stockbridge, Georgia. I live in the Valley Hill Station subdivision. Um I disapprove of this. I know Henry County and Stockbridge, you know, we it's growth, growth, growth. [1:39:30, 1:39:44]: But most of the residents, and I hear you saying older residential areas, well, I'm I'm speaking for myself, but most of the the residents that moved in, that's why we moved in the area, because we wanted an older, quieter residential area. [1:39:44, 1:39:48]: We moved to Stockbridge because we didn't want to be in Atlanta with [1:39:49, 1:39:52]: with the tall buildings and all that. So [1:39:52, 1:39:57]: And then so I disapprove of this zoning because I came to a meeting before [1:39:58, 1:40:00]: On the other side of our subdivision [1:40:01, 1:40:02]: Із гана бі а черж. [1:40:02, 1:40:03]: Or some type of [1:40:04, 1:40:09]: building or you rezoning something on the other side of our subdivision, then at the end [1:40:10, 1:40:11]: A Valley Hill. [1:40:11, 1:40:14]: Before you get to the railroad station, you're doing something there. [1:40:15, 1:40:19]: then just like the guy the uh the owner said you have another [1:40:19, 1:40:21]: subdivision next to Rico's. [1:40:22, 1:40:25]: Well, to me, that's too much rezoning. [1:40:25, 1:40:27]: In our area. [1:40:27, 1:40:31]: It's too much traffic going down the two lane highway. [1:40:31, 1:40:32]: It's already busy on [1:40:33, 1:40:46]: Henry, and I know you're making the four lane highway. So I just say I'ma disapprove of that because it's too much going on. That's why we moved in the area because it was quiet and then it's butting up against our neighborhood. So I disapprove of it. [1:40:48, 1:40:54]: Thank you. Thank you so much, Ms. Please remember to fill out that form and give it to staff. Is there anyone else that is against and would like to speak? [1:40:58, 1:40:59]: Please. [1:41:03, 1:41:20]: Good evening. And thank you for allowing me the opportunity to speak. My name is Yolanda Barber. I live at 197 Town Place. I am also the City Council District Representative of this particular area for this proposed development. [1:41:21, 1:41:34]: I'll first say I'll withhold my decision because I know this proposal is going to be presented to the council, but I want to speak on behalf of the homeowners in my district who live in this area. [1:41:35, 1:41:38]: I'm not opposed to developments. [1:41:38, 1:41:39]: I'm not. [1:41:39, 1:41:43]: The concerns that I have of the homeowners who live in this area. [1:41:43, 1:41:47]: They were recently annexed in twenty twenty three. [1:41:48, 1:41:55]: As you heard one of them say, they moved to this particular area for the quietness, the quaintness. [1:41:56, 1:42:04]: Most of the homeowners that I spoke to that live in this area that were annexed in 2023, they were opposed to the annexation. [1:42:05, 1:42:10]: I've spoken with them. They are not opposed to developments. [1:42:11, 1:42:14]: I have been able to explain to them the vision. [1:42:15, 1:42:16]: Of our city? [1:42:17, 1:42:25]: That particular area is along a major corridor. It is the gateway into our city if you're coming off of I-675. [1:42:25, 1:42:32]: That area is state route forty two, and I know I saw some slides that keep mentioning North Henry Boulevard. [1:42:33, 1:42:33]: But [1:42:34, 1:42:35]: That's state route forty two. [1:42:36, 1:42:37]: It's a state route. [1:42:38, 1:42:41]: It is where you would want your commercial developments. [1:42:42, 1:42:45]: Not to say that mixed use developments are not good there. [1:42:45, 1:42:50]: But currently there are no residential developments in that area. [1:42:51, 1:42:52]: I wanna ask. [1:42:53, 1:42:59]: You all as the planning commission, do you all get the housing inventory? [1:42:59, 1:43:04]: That our planning and zoning department is responsible for compiling. [1:43:07, 1:43:16]: Uh Councilman no, but I did ask for and request that at the last meeting I had. I think it is important as the planning commission that you all help plan. [1:43:17, 1:43:21]: You are the planning commission. You should know nine [1:43:21, 1:43:24]: Residential developments have been approved. [1:43:25, 1:43:28]: In city council district four in the past two years. [1:43:28, 1:43:29]: Nine. [1:43:29, 1:43:35]: That's 998 residential units. [1:43:36, 1:43:38]: All within city council district four. [1:43:39, 1:43:45]: This particular area of our city, of course, is in my district. It is being overly saturated. [1:43:45, 1:43:46]: With [1:43:47, 1:43:48]: Um town homes. [1:43:49, 1:43:55]: If you would look at the housing inventory that our planning and zoning department has. [1:43:56, 1:43:57]: You should be able to [1:43:57, 1:44:04]: Take a look at each district, each area and see what the housing needs are. [1:44:05, 1:44:10]: This homeowner was smart enough to she recognizes there's already [1:44:11, 1:44:16]: Three developments that have been approved along Valley Hill Road. [1:44:18, 1:44:18]: Three. [1:44:19, 1:44:20]: Along Valley Hill Road. [1:44:21, 1:44:23]: Davis Road, the next street over. [1:44:24, 1:44:27]: There's an existing development aren't already under construction. [1:44:28, 1:44:30]: It too is high density. [1:44:30, 1:44:36]: I'm concerned. I'm concerned about this particular area because it seems as though it's being targeted. [1:44:36, 1:44:37]: And [1:44:37, 1:44:43]: I don't have an issue with um the proposals. It's that I would prefer that our city [1:44:44, 1:44:44]: Plan. [1:44:45, 1:44:48]: We need a master plan for that particular area. [1:44:49, 1:44:56]: A master plan that will give us a guide on um what we can do to help revitalize or [1:44:56, 1:44:59]: redevelop that entire area. [1:44:59, 1:45:00]: Um [1:45:02, 1:45:22]: Another issue that I have, the letter that was mailed to the homeowners. I know our code requires that the developer mail letters to homeowners who are within 500 feet from this proposed development. So there was only a select few. [1:45:22, 1:45:26]: Of the homeowners who live in Valley Hill Station who received this letter. [1:45:27, 1:45:30]: The letter was mailed, I guess, April first. [1:45:30, 1:45:35]: On the letter it says the community zoning meeting was scheduled for April second. [1:45:37, 1:45:41]: When I looked at the city's website, it showed the community zoning meeting. [1:45:41, 1:45:48]: That the city was hosting was scheduled for April seventh, I believe. I showed up here. [1:45:49, 1:45:54]: I will read the same statement that I made during that community zoning meeting. [1:45:54, 1:45:55]: Hosted by our city. [1:45:58, 1:46:07]: During this council's recent retreat, our city's financial advisor advised us that our tax digest was imbalanced. [1:46:07, 1:46:11]: He stated currently our text digest shows [1:46:11, 1:46:14]: Seventy thirty or sixty forty percent. [1:46:14, 1:46:19]: of our taxes are being shouldered by homeowners. It should be reversed. [1:46:20, 1:46:21]: It should be more. [1:46:22, 1:46:23]: Commercial. [1:46:26, 1:46:28]: He mentioned also [1:46:29, 1:46:31]: That we need more commercial businesses. That means more [1:46:32, 1:46:34]: Commercial, not more townhomes. [1:46:34, 1:46:36]: Not more residential. [1:46:39, 1:46:46]: The council has approved nine separate development proposals within City Council District Four. [1:46:47, 1:46:48]: That's my district. [1:46:49, 1:47:04]: I'm concerned because this particular area of my district, the north end of our city, most of those newly annexed residents in twenty twenty three came from that area. That's my district. So not only are you [1:47:05, 1:47:08]: Налий з пропозом [1:47:08, 1:47:11]: Disrupting the peace of the people. [1:47:11, 1:47:22]: They're calling me with concerns. It's not that I don't support growth, it's not that they don't support growth. We need smart, responsible growth. [1:47:23, 1:47:31]: Currently, there are no plans other than the widening of State Route 42. There are no plans for infrastructure improvements. [1:47:33, 1:47:40]: So I hope that you all will consider that in your decision. This is a request. [1:47:40, 1:47:44]: A request by the applicant to amend our comprehensive plan. [1:47:45, 1:47:46]: E request. [1:47:49, 1:47:50]: Um [1:47:52, 1:47:57]: That particular area of state route forty two not only is this parcel um [1:47:57, 1:48:01]: available for development. There are multiple [1:48:01, 1:48:04]: parcels along that stretch of road. [1:48:04, 1:48:10]: Which means it's gonna be piecemealed over the next year or two as those property owners may come forward. [1:48:11, 1:48:15]: I want to master plan that entire area. [1:48:16, 1:48:25]: Master planning first so that we can apply the appropriate zonings that will best fit what we need here in our community. [1:48:25, 1:48:26]: Um [1:48:27, 1:48:31]: I see that this proposal it does not mention anything about a clubhouse or a pool. [1:48:33, 1:48:34]: Something to consider. [1:48:36, 1:48:36]: Mm. [1:48:36, 1:48:39]: This is a gateway to our community, to our city rather. [1:48:43, 1:48:47]: Uh Chairman, may I speak to Council Warman? [1:48:49, 1:49:09]: I have a concern about some of the questions that you've been asking. In reality, it doesn't matter what this board says or do at the end of the day. The city council ha has the responsibility of either turning down our decision or passing the decision. [1:49:09, 1:49:24]: that we make. So at the end of the day, when you speak to me about all this planning or this board, really it's up it's your responsibility at the end of the day. And we basically follow your lead. We have no [1:49:25, 1:49:35]: Solid responsibility when it comes to decision making because at the end of the day your counsel can change everything we say and do on this committee. [1:49:37, 1:49:40]: Am I able to respond? Yes. [1:49:41, 1:49:44]: Thank you for that sentiment. You're absolutely right. [1:49:45, 1:49:46]: Which is why I'm here. [1:49:47, 1:49:47]: Um [1:49:48, 1:49:49]: A share in your concerns. [1:49:50, 1:49:50]: Um [1:49:52, 1:49:56]: You were sworn in just like I was to protect. [1:49:57, 1:50:16]: our community to be fair, honest, transparent, do your due diligence, such as asking for the housing inventory, asking for the council's plan of infrastructure improvements. All those things are basic planning. [1:50:17, 1:50:17]: Task. [1:50:19, 1:50:21]: Mr. Anderson will be [1:50:21, 1:50:23]: More than willing to provide you all with [1:50:24, 1:50:25]: More details. [1:50:25, 1:50:31]: I know that the decision that you all make here are just recommendations for the council. [1:50:31, 1:50:35]: But I want to make sure that you are doing your full due diligence. [1:50:35, 1:50:37]: Before you make decisions. [1:50:37, 1:50:40]: I don't take any of these decisions lightly. [1:50:40, 1:50:47]: As a member of the governing body, I know my decisions are impacting the lives of people who live here. [1:50:48, 1:50:50]: Everybody doesn't want the growth. [1:50:50, 1:50:51]: I get it. [1:50:52, 1:50:54]: But we have to find a happy median. [1:50:55, 1:50:58]: We have to be responsible with the decisions that we're making. [1:50:59, 1:51:01]: I don't just go along to get along. [1:51:01, 1:51:02]: I just want to do [1:51:03, 1:51:09]: What's right, I'm gonna do the best that I can to represent the people in their interest. [1:51:09, 1:51:10]: Thank you so much, Councilwoman. [1:51:11, 1:51:11]: Thank you. [1:51:12, 1:51:15]: May I add one more comment to her conversation? [1:51:15, 1:51:34]: Give me one give me one more uh give me one moment. Thank you, Councilwoman. You're good. Thank you. Is there anyone else that would like to speak on behalf or against uh the current rezoning and comprehensive plan amendment case? All right. I will now close the public hearing and I'll allow you, Mr. Thibodeau, to speak. [1:51:36, 1:51:56]: I would love for this committee to have a a lot of input when it comes to the planning of the communities and and commercial property. But at the end of the day, I I can still ask the question: why do we have employees in the planning zoning if we don't have [1:51:56, 1:52:02]: Mm-hmm. [1:52:02, 1:52:17]: and also with the city council. So we've never had meetings uh total with the uh planning zoning or the city council to set forth the future development of this city. [1:52:19, 1:52:25]: While I wh why I agree with you, um, unfortunately if three or more of us is in a room and we meet quorum [1:52:26, 1:52:33]: And that's to technically an official meeting. So I mean if we can find some avenues to get around that, I I can stand with you on that. Um but at this time [1:52:37, 1:52:56]: Mr. Chairman. Yes, sir. I have a follow-up question for staff. Sure. If I could. In regards to the notices that would have gone to the residents, particularly those within 500 feet, how many letters were sent and how many people may have been, or how many people were at the actual forum, the community forum? [1:52:56, 1:52:58]: Do we send the letters or do the applicant? [1:53:03, 1:53:23]: The reason I ask is sometime back we we spoke as a com as a commission here about uh whether or not we would be advised when letters were sent as part of the uh the presentations, when those were sent, how many were sent, et cetera. I don't I don't see anything here. Um Councilwoman Barber mentioned that letters were sent. [1:53:23, 1:53:34]: The C Z I IM is just a it's just a custom it's just a customary meeting we have. Just it's courtesy. It's not mandated or anything. Okay. [1:53:34, 1:53:54]: We requested it, that's why I mentioned Yes. Do we know how many letters were sent? It's just another form of grassroots planning we were trying to implement. So we just have that as another layer for staff for for residents to have a say in participation. So only only two meetings that are mandated is planning commission and city council meeting. [1:53:54, 1:53:56]: It's just a courtesy meeting, the C Z IO. [1:53:56, 1:54:12]: I I think uh Ryan he's referring to uh the letter that goes out to those surrounding areas from the applicant. The residents five hundred feet. Yeah, all those that were that were then five hundred feet of the property line were sent the letter. I'm not exactly sure how many, but there wasn't very many. [1:54:14, 1:54:15]: Is that so? [1:54:17, 1:54:32]: Uh yeah, I I'll take that. Thank you. All right. Um at this time we're gonna we're gonna do a vote uh separately on these two matters. Do I hear a motion or do I have a motion regarding comprehensive plan amendment case C P dash twenty twenty five dash O two? [1:54:33, 1:54:36]: I have a motion. Ms. Walker. To deny. [1:54:37, 1:54:45]: All right, there's a motion to deny by Vice Chair Walker. Okay. Oh sorry, approval first. [1:54:46, 1:54:50]: You don't have to do an approval. If there's a motion to deny, then there's a motion to deny. [1:54:51, 1:55:00]: Is there a second to the motion to deny? A second. There's a sec or a motion by Miss Walker and a second by Mr. Dumas. All those in favor, please uh indicate by the sign of aye. [1:55:01, 1:55:02]: Uh. [1:55:03, 1:55:05]: All right. All those opposed? Nay. [1:55:06, 1:55:06]: Thanks. [1:55:06, 1:55:12]: All right, there's are three ayes and two nays. The comprehensive plan amendment case is denied. [1:55:16, 1:55:18]: That's why you have to ask for approval first. [1:55:20, 1:55:23]: Chair Chairman, would you mind my repeating the motions and a vote, please? [1:55:24, 1:55:35]: Yep, the motion wa there was a motion to deny the comprehensive plan amendment case, C P dash twenty twenty five dash O two by Miss Walker. It was seconded by Mr. Dumas. Uh the vote was three to two. [1:55:40, 1:55:45]: Do I have a motion regarding rezoning case R Z dash twenty twenty five dash O three? [1:55:48, 1:55:53]: Actually, Ryan, since we didn't approve the the comprehensive plant, is it an automatic [1:55:54, 1:55:54]: Oh. [1:55:55, 1:55:58]: We still need to vote for the record. [1:56:02, 1:56:15]: Thank you, Madam Attorney. Um so I will accept a motion regarding the rezoning case. Mr. Chairman, this is Dave Planchan. I'd like to make a motion to accept the rezoning of the property to conform with the land use plan. [1:56:16, 1:56:33]: There's a motion to accept the rezoning case. Is there a second? Uh Harold, I'll second it. All right. There's a motion and a second by Mr. Chibidot. All those in favor of approving the rezoning case, please indicate by the sound of aye. Aye. Aye. All those opposed? [1:56:33, 1:56:40]: I oppose. Opposed. All right. That motion uh was denied two to three. I need to do a second motion. [1:56:41, 1:56:42]: All right. [1:56:44, 1:56:48]: The next item on tonight's agenda is project updates. Do we have any updates from staff? [1:56:56, 1:57:03]: I'll also combine that with staff comments. Are there any project updates and staff? I'm sorry, you do need to do a motion to den to deny. [1:57:03, 1:57:05]: So we do need okay. [1:57:09, 1:57:16]: Thank you for uh confirming that. Do I hear a motion to deny the rezoning case R Z dash twenty twenty five dash oh three? I'll make a motion to deny. [1:57:17, 1:57:23]: All right, there's a motion by Ms. Walker. Is there a second? A second. A second is by Mr. Doomis. All those in favor, please indicate by the sound of aye. [1:57:24, 1:57:25]: All right. [1:57:25, 1:57:30]: All right, all those opposed? Nay. All right. The motion passes three to two. [1:57:31, 1:57:40]: The next item on tonight's agenda is project updates and staff comments. Do we have any comments or updates from staff? No comments tonight, Chairman. All right. Are there any board comments? [1:57:42, 1:57:53]: Hearing none, I will say um have a great holiday weekend. I know some of us are off on Friday. Uh so happy Easter, happy resurrection Sud Day. Um at this time I'll take a motion for adjournment. [1:57:54, 1:58:05]: Mr. Chairman, I make the motion to adjourn. Is there a second? All right, there's a motion to second to adjourn. All those in favor indicate by the sound of aye. Aye. Aye. Meeting is adjourned at 824 P.M.
