[0:28:52, 0:29:00]: And our our assistant took note of that. Okay. Go ahead, please. Appreciate you. Thank you. Anybody else? [0:29:00, 0:29:18]: Okay. All right, great. Thank you. And need your um motion to approve those minutes, please. [0:29:22, 0:29:23]: So moved. Is there a second? [0:29:25, 0:29:36]: Ms. Barber seconds that from Miss uh Gantt to Miss Barber, all in favor, please indicate. Okay, approval. All approved. Okay. Um [0:29:41, 0:29:48]: Is it I there I all in favor of the minutes? Councilman Thomas, she's asked to be a little bit of a little bit of a [0:29:55, 0:29:55]: Can't hear. [0:30:02, 0:30:02]: I'm sorry. [0:30:03, 0:30:08]: I did call for vote order. All all in favor of the motion, please indicate. [0:30:08, 0:30:10]: And I got it all affirmed up here. [0:30:10, 0:30:11]: All four. [0:30:15, 0:30:35]: Thank you. All right. What we have next, ladies and gentlemen, is a public hearing. We've got three different public hearings, three different issues uh to cover tonight. So what I'm gonna do is I'm gonna go through initially go through the public hearing rules to cover all three, and we're gonna go through and what I see here, Mr. Ryan, you have uh you have all three of these you'll be presenting. [0:30:35, 0:30:38]: uh but they are they're actually are uh [0:30:39, 0:30:46]: Yeah, one's uh two of district four and one's uh uh city wide. So let me go through the public hearing rules at this point. [0:30:47, 0:31:07]: Please mute all cell phones and other electronic devices. If anyone wishes to speak tonight on a public hearing item, please fill out the form available on the table and hand it to the city clerk before approaching the podium. Other than the applicant, no person may speak more than [0:32:05, 0:32:25]: Than once the applicant may reserve part or of his or her speaking time as a rebuttal and may speak next and last and may use the entire 10 minutes allowed for the pro side of the application. If questions are raised, the council may ask the applicant to address questions andor concerns. A second for the motion, and we have [0:32:25, 0:32:45]: Any necessary discussion. If the matter is not tabled, the presiding officer will call for a vote to recommend approval or denial of the request. First item for the public hearing deals with the text amendment case TX 2025-01 Council District 4. This is a second reading. Council consideration of text amendment to amend title. [0:32:45, 0:33:05]: twelve Unified Development Code, Section 2.5.3E and Section 2.5.3 F of the City Stockbridge Code of Ordinances relating to the downtown village, DT overlay district, so as to add certain uses to the list of special use requiring a special use permit and to remove certain uses from the list. [0:33:05, 0:33:19]: of prova uh prohibitive uses to allow them to now be permitted uses, provided that the certain requirements are met to provide for severe urgency severe severe ability to repeal conflicting ordinances [0:33:19, 0:33:39]: To provide an effective date for all uh per other purposes. Mr. Anderson, please. Uh good evening, Mayor and Council. Uh Mayor, since this is the um second reading and for the sake of time, I'll just give a brief summary and then we can go into the public hearing. Okay. We uh we did the first reading at the council work session two weeks ago. Okay. [0:33:44, 0:33:55]: Once again, here's a um a map of the downtown village overlay district shown in the um in the lilac color in the PMU which it abuts is shown in the la um in lavender. [0:33:57, 0:33:59]: You can't hear me? Oh, sorry, buddy. Okay. [0:34:00, 0:34:02]: Okay. Um [0:34:04, 0:34:24]: The location of the downtown village overlay district. It mainly consists of the historic city of Stockbridge area and it also includes some adjacent parcels. The DTV, the DTV overlay district regulations shall take precedence over the regulations of all other districts, including the base zoning districts and [0:34:24, 0:34:32]: Any other type of overlay district. The requirements of this district are not intended to apply existing single-family residences. [0:34:34, 0:34:54]: Uh the purpose of the downtown village overlay district is to recognize and affirm the function of the existing traditional downtown as the central focus of commercial, artesian, and civic activities within the community. Two, to allow the existing downtown to flourish, intensify, and expand where wherever it may be appropriate in a manner that is consistent with [0:34:54, 0:35:01]: its traditional character. Three, to provide a local retail, service, artesian, and civic center for the community. [0:35:03, 0:35:06]: Here's the current regulations of the downtown overlay district. [0:35:08, 0:35:20]: Um all permitted uses within the downtown district, residential units which are located above floors and on the rear of commercial and office uses. [0:35:24, 0:35:37]: Special uses, current special uses in the overlay district includes uh bed and breakfast establishment, multi-family residential, passenger depots, and transit shelter, uh, single family residences. [0:35:40, 0:35:44]: Proposed changes by the recommended by the planning and zoning staff includes [0:35:46, 0:36:06]: Well here's a summary of our other ch of the changes we're proposing. We're we're we're proposing to amend title twelve of of the UDC section two point five point three E and Section two point five three L for the downtown village overlay to accomplish the following. Number one, add certain uses to the list of special uses requiring a special permit. So basically [0:36:06, 0:36:26]: Basically, what we're doing is taking certain permitted uses, things that are already allowed by right, and making them governed by a special use permit. This will give council more discretion over what is being allowed downtown. Number two, remove certain uses from the list of prohibited uses and allow them to now be permitted uses, provided that they meet certain requirements. [0:36:26, 0:36:46]: Requirements. Reasons for this text amendment: businesses are interested in locating certain uses in the DTV overlay district, but they are not currently allowed. Such uses are already allowed within the adjacent Parkway mixed-use overlay district, which abuts the downtown district along North Henry Boulevard. Proposed actions replace [0:36:46, 0:36:52]: Remove and replace the existing existing section 2.53E and section 2.53F. [0:36:58, 0:37:18]: So all special uses that's provided in the downtown district, uh bed and breakfast establishments, gasoline station, minor automobile service repair maintenance centers, car washes, convenience stores, and other associated uses. Note these uses are already allowed in the downtown village overlay district, but now we're proposing [0:37:18, 0:37:38]: That they require a special use permit. Like I previously mentioned, this will give council more discretion over these particular uses. Also, it would allow multifamily residential buildings. We need this option so that we can develop the city-owned property downtown that is that's adjacent to City Hall. Because currently we can't develop that mixed-use project because apartment. [0:37:38, 0:37:52]: Farmers aren't allowed downtown. Also, it would add passenger depots and transit shelters, restaurants, takeout establishments, banks and pharmacies with drive-through windows and single family residence. This is what we're proposing to add. [0:37:56, 0:38:06]: Um, list of requirements for special use per uses. A special use must be located on a property which has frontage on either a collector or an arterial road, as is classified f [0:38:07, 0:38:27]: By the Georgia Department of Transportation or the Henry County Department of Transportation. The property must have a base zoning district which allows such uses. All property designs of the base standard of the base zoning district must be met. All existing nonconforming structures may not be enlarged. Building facades on both for both primary and accessory structures. [0:38:27, 0:38:30]: must be constructed of brick on all sides. [0:38:34, 0:38:54]: Um at gasoline stations that are allowed in the DT, in the DTV overlay district with a special use permit, must have an equal number of electric charging stations as gas pumps must be provided on site. Covered canopies must be provided over gas pump and electric charging stations. All acceptable means of of access. [0:38:54, 0:39:05]: And internal circulation must be provided to be determined by the fire marshal. The required number of parking spaces must be provided. The required buffers must be provided. [0:39:06, 0:39:26]: Uh the current and proposed, well, the new proposed list of prohibited uses in the downtown village overlay district. Uh number one, adult entertainment establishment, boarding and rooming homes, including personal care homes, catering establishment, child and adult daycare centers, consignment and thrift stores. [0:39:26, 0:39:46]: Family daycare homes, payday loan, title loan, and money exchange establishment, places of worship, public and private schools and related facilities, tobacco and vape shop, tattoo and piercing studios, extended stay, motels and hotels. I mentioned personal care homes earlier, but it [0:39:46, 0:40:01]: It's um part of four and six, so we just added it again at number thirteen, so we can be clear on that, that personal care homes will not be allowed in the downtown village overlay district. Um and staff recommend approval for these changes. [0:40:02, 0:40:03]: Mm. [0:40:05, 0:40:08]: Okay, council any questions or concerns for writing, please? [0:40:10, 0:40:20]: Several. So this affects my district. The downtown area is within City Council District Four. It's the district that I represent. [0:40:21, 0:40:24]: I know that it is a district that is uh [0:40:24, 0:40:30]: has high interests from our councilmates, investors and everyone else. [0:40:30, 0:40:34]: I want to make sure that we grow our downtown. [0:40:34, 0:40:38]: Ам, со да і локс лил тrivни downтоwn. [0:40:39, 0:40:41]: На компотион ви [0:40:41, 0:40:43]: А лата диффер. [0:40:44, 0:40:52]: One of the questions I have though, I saw the restricted uses. You have um vape shops and tobacco shops. [0:40:53, 0:41:00]: But I don't see tattoo parlors, I don't see nail salons, I don't see barber shops. [0:41:00, 0:41:06]: hookah bars, hair salons, storage facilities, and gasoline shops. [0:41:07, 0:41:09]: I know that there are distance requirements. [0:41:09, 0:41:10]: Um [0:41:10, 0:41:12]: In the is it the overlay districts? [0:41:13, 0:41:15]: That has the distance requirement. [0:41:15, 0:41:20]: The op the uh the dist the distance requirement is citywide. Okay. Citywide. [0:41:20, 0:41:35]: Okay. Well what I want to make sure is that we don't have an over saturation of those businesses. Yes. The ones that I just named. Mm-hmm. So in our downtown. So this list that you have here, I want to make sure that you include [0:41:35, 0:41:37]: Tattoo parlors. It's on the list. [0:41:37, 0:41:40]: Where is that? I put it back. Okay. What about mill salons? [0:41:41, 0:41:45]: Nell Salon's there it's governed by the um the distance requirement. [0:41:47, 0:41:52]: I still would like for you to include it in this list here. Is there a problem with you including it? [0:41:53, 0:41:55]: Mm, no but w um [0:41:55, 0:41:57]: Okay. I'd like to include [0:41:58, 0:42:01]: Nelsons, barbershops. [0:42:01, 0:42:05]: Hookah. Do you have hookah lounges or hookah bars on here? [0:42:05, 0:42:18]: uh tobacco and vape shops. Not not specific who cares lawns, storage facilities, and gas stations. We don't need another gas station in our downtown. And at convenience stores. [0:42:19, 0:42:19]: Okay. [0:42:20, 0:42:21]: We don't need another convenience store. [0:42:24, 0:42:31]: The other um question I have though with the map, can you go to that map again? Um [0:42:32, 0:42:33]: Rest. [0:42:35, 0:42:40]: I know that the DDA map does not include Stockbridge. Um [0:42:41, 0:42:53]: Lakes bed and breakfasts, it should. It's the only business that's left outside of the DDA boundaries. But I like to include Stockbridge Lakes Bed and Breakfast. [0:42:53, 0:43:00]: In this map as well. Okay, this is the the overlay uh district is separate from the uh the DDA map. I know. Okay. I know. [0:43:01, 0:43:08]: Okay. I'm just adding all of this for the record. Okay. However you can make this work, Mr. Edmondson. [0:43:09, 0:43:10]: Um [0:43:14, 0:43:21]: So I wanna ask though, what's driving this request? All of a sudden it came forward. Curious to know. The city owns three acres across the street. [0:43:22, 0:43:24]: And currently can be developed. [0:43:24, 0:43:27]: Because apartments aren't allowed in a downtown village overlay district. [0:43:28, 0:43:43]: That's one of the main factors behind that. Other than that, it's just uh good long range planning strategy by the department taking a proactive step, trying to improve downtown and to encourage the right types of uses in downtown. That's the aim of it. [0:43:44, 0:43:45]: So we are [0:43:46, 0:43:50]: So you're asking us to approve a text amendment to accommodate [0:43:51, 0:43:52]: that proposed development. [0:43:53, 0:43:55]: I don't support it. I won't support it. [0:43:56, 0:44:01]: Those three acres um are better suited for green space, perhaps to fifteen acres. [0:44:02, 0:44:08]: What I don't like is if a proposal is submitted to us and if it does not fit [0:44:08, 0:44:11]: our current standards or requirements here. [0:44:12, 0:44:14]: I'd rather us not try to make things fit. [0:44:15, 0:44:17]: to accommodate the proposals. [0:44:18, 0:44:28]: But nonetheless, I want to make sure that I'm on record with all of those other restrictions that you don't have on your list. This is my district. It affects [0:44:28, 0:44:30]: Residents and other businesses in the area. [0:44:31, 0:44:32]: And I don't want to [0:44:33, 0:44:34]: Saturate. [0:44:35, 0:44:36]: The downtown. [0:44:36, 0:44:38]: That's supposed to be a special [0:44:38, 0:44:56]: district for entertainment, for dining and other recreational activities. Um so those are my comments. Another thing we're trying to do, we have s of a downtown um study or plan that has several recommendations and um [0:44:58, 0:45:15]: some of the some of the um suggestions in that study, um conflicts with the current UDC, some of the recommendations from that from that study. So we're just trying to clear that up that up so that we can properly implement that study and the and the recommendations from that study. [0:45:15, 0:45:21]: So will you be making other recommendations to us for the fifteen acres the city owns as well? [0:45:21, 0:45:22]: Which fifteen acres? [0:45:23, 0:45:28]: The ones at the corner of Rock Quarry and North Henry, behind the Sherwin Williams. [0:45:28, 0:45:39]: Um I'm not sure. Uh w we probably will get to it, but I'm not sure right now. But more than likely we'll look at it. We'll we'll definitely take a look at it, but I'm not sure what type of recommendations we'll make. [0:45:40, 0:45:45]: Okay, I want to, if I may ask, um, because Mr. Edmondson [0:45:46, 0:45:48]: If you don't mind, sir. I know that [0:45:48, 0:45:51]: I wanna know, have you taken a look at this at all? [0:45:56, 0:46:06]: Because I wanna make a recommendation that we table this to continue the discussions, um, to allow you some time to review this if you had not. [0:46:07, 0:46:27]: Um yes ma'am, I have. Um and we had uh small discussion about it. Uh it is my understanding that this was kind of presented uh to also be coming into alignment to the comprehensive plan that we have uh on file right now. Um and also to your concern about those particular items, i.e. [0:46:27, 0:46:47]: convenience stores, etc. The council has the ability to implement a moratorium. And what that allows is in case one do come and apply for a license, if we don't change anything, right, they can actually apply for those licenses. And then what you can do is you could do a moratorium. A moratorium can be up to six months where we go out and study the impact [0:46:47, 0:47:07]: of those type of stores that are prohibited or that falls not le neatly in this particular uh ordinance and that gives us the ability to do some research on it and come back and and and give our recommendation. Um so I I like I said I had glanced over it, they know the history of this where we at. Um I see this in alignment, but [0:47:07, 0:47:25]: Of of course that's up to the government authority to decide whether or not what you will allow it or not. But I did take a look at it initially and uh Mr. Anderson did explain to me the reason why this was to try to come more in in alignment not only with the comprehensive plan, but also the UDC. Correct? Yes, sir. Yep. [0:47:25, 0:47:26]: Mm. [0:47:27, 0:47:29]: Uh um [0:47:31, 0:47:32]: I think we need to have some more [0:47:33, 0:47:33]: In depth. [0:47:34, 0:47:36]: Discussions regarding this. [0:47:36, 0:47:42]: I know our retreat is in September. Perhaps that may be a better time for us to continue discussing this. [0:47:43, 0:47:46]: So I'll wait and I'll yield to my councilmates, but I [0:47:47, 0:47:52]: want to suggest that we table this until then. This is in my district. [0:47:52, 0:47:53]: Thank you. [0:47:54, 0:47:57]: Ms. Oh m Ms. I'm sorry. Thank you. [0:47:57, 0:48:17]: Thank you, Mayor. Um, I'm in favor of this, and I'm gonna there's several reasons why. We've been talking about this for years. Um the LCI was done way before any of us was on Mayor and Council. It was part of the plan, it is on the plan, and it's um part mixed use development. Um I'm also in favor [0:48:17, 0:48:26]: I'm not in favor of eliminating a convenience store, the right type of convenience store in a mixed use development. And what I mean by that is [0:48:27, 0:48:47]: Um the downtown area, if you've ever been to an Avalon or if you've been to Atlantic Station or if you've been to Trilleth down in um Fayetteville, there is a a lot of mixed use buildings with living up top, commercial down below. Now we do have some areas now, thank goodness. [0:48:47, 0:49:07]: Over on the bridges of Jodico. That could be a great example of what we're trying to do in our downtown. Downtown, a goal of ours is live, work, and play environment. This is nothing new. We just need to move the needle forward. We've been planning this for years. We've been planning this before 2020. [0:49:07, 0:49:27]: 2013. We've been planning this in 2010 when they did the vision of it with the LCI plan with the amphitheater, their splash pads, your art center, your community center. All of this is coming into play. And so to be able to do what we planned for so many years. [0:49:27, 0:49:47]: We have to start implementing the groundwork and rules to go by that. And these conditions are perfect for what we're wanting. What we're saying is if we get a mixed-use development, which we are working on, and developer there is a a a developer, I believe, that is interested, or developers. [0:49:47, 0:49:54]: that may be interested in creating this downtown that we've planned out, that's been planned for a very long time. [0:49:54, 0:49:55]: That [0:49:56, 0:50:00]: These are the things that we want to exclude in our downtown area. [0:50:01, 0:50:17]: Um, as you heard from our city manager, he has been brought up to par on to what the plans are. We have this in place and I don't think this is the proper time to keep kicking the can down the road. I think that it's time for us to start some of the groundwork. [0:50:18, 0:50:38]: On what we're trying to do for this development. And if you haven't heard, then I'm here to let you know that in the past, and some this is something I'm really, really proud of. In the past, you would ask young adults, those who are just graduating from high school, if they wanted to come back and live and [0:50:38, 0:50:46]: Stockbridge? And the answer was no. They're going off and they're moving to another city, they're moving to another state, but they weren't coming back home. [0:50:46, 0:50:49]: I'm proud to say that we were at a dinner. [0:50:49, 0:51:09]: Um one night and we had a young urban professional and we've had some other young urban professionals who are saying Stockbridge is the place to be. They're moving and shaking and they want to come home. But they also we also have to provide that home type of environment that they're looking for. And that environment is the live, work and play environment. [0:51:09, 0:51:29]: That we plan on providing. That includes the restrictions that Mr. Anderson just provided to us. And those restrictions, minus the convenience store. And the reason why I say minus a convenience store, I've been down to Trilleth and Avalon and different places where you go when you live in that environment. [0:51:29, 0:51:49]: You need a a store to go to, right? If if I'm living across the street and I just happen to, you know, need a first aid kit, or I just happen to want something to drink, um, uh Coke or whatever, and there's a store within my my community, then I want to be able to go. [0:51:49, 0:52:04]: go walk right there and get it. So I don't want to eliminate the ability to have a convenience store, ice cream store shops and and or not even a an hair salon within [0:52:04, 0:52:24]: a community, a spa, right? You don't want you you don't want to make it so restrictive, but you want to make rules and regulations by it. So a specific, you know, they'll have to come to us and ask permission and we can add on different conditions as as we see fit, as we deem fit, the way it should look. [0:52:24, 0:52:44]: Look, right? Those type of restrictions. However, in addition to that, um we mentioned vape shops and hookah shop. I don't know if we're saying shops or bars, but what I can let you know is is that I I'm not for hookahs, let me just say that. But people in in [0:52:44, 0:53:04]: In those type of environments, in the club environment, if there's a cigar bar or lounge within that environment, depending and making it as nice and as strict as possible as far as ambiance is concerned, those type of things should be allowed in our downtown area because that district has an open container district. [0:53:04, 0:53:24]: It is kind of it it will be an entertainment district. And I need us to kind of open our eyes and broaden our thought process on having young urban professionals in our downtown because we don't want our community to die out. We don't want it to be a place where, you know [0:53:24, 0:53:44]: No one wants to thrive and and and live and survive. And we're making it that. And there are so many young people now that are looking, young families who are just getting married in their early 20s, 30s are saying they want to make Stockbridge home. And these are the type of environments that they want to make it in. [0:53:44, 0:54:04]: So I'm not in favor of prolonging this. I am in favor of getting it done. We have seen this before. We've seen it numerous amounts of times, and I'm ready to vote tonight. Yes. Mr. Alexander, go ahead, please. Thank you so much. Uh the downtown vision is really brilliant and it is [0:54:04, 0:54:24]: A focus of this council and has been for the entire period that I was on here. Downtown literally died a slow death. And to see what we saw over the weekend, oh my God, to see downtown crowded with people out in the street, sitting outside, the pizza bar. [0:54:24, 0:54:36]: are overflowing with customers. Frozen Smoke got customers. The downtown social got customers. Showtime got customers. That hasn't happened. What we're doing is working, is showing the right course. [0:54:37, 0:54:57]: And I will stand on this amphitheater because it's driving what we're doing. As Ms. Gann has indicated, we're building an entertainment district. That's something that Henry County hasn't had before, where our young urban professionals and even senior citizens can enjoy nice music. Well, we had a tiny tent on [0:54:57, 0:54:59]: Friday and we had [0:54:59, 0:55:19]: People is sitting out there enjoying. It was a diverse mix of people sitting out enjoying our downtown. We haven't had that in years. We're on the right course. Doing and I cannot thank the proprietor of 114 Martin Luther King Senior Heritage enough and 118, which is frozen smoke. [0:55:19, 0:55:39]: Mr. Sylvan deserves a tremendous amount of credit for believing in where we're going in downtown Stockbridge. He owns both of those buildings. Now the 114 was a dilapidated mess about 18 months ago. Now it is a beautiful facility with Crown Pizza Bar in it. [0:55:39, 0:55:59]: It is outstanding and it is drawing. It is drawing as the central gathering space that we've always wanted. And as we look at the LCI across the street having the mixed use development, we've seen it. We see it every day when I drive down to Argento to Costco, when I drive down to [0:55:59, 0:56:19]: Sprouts farmers market. Those areas are thriving. You got people out there walking. You got people out there enjoying the entire event. And I'm not going to sit over here with my senior citizen self and tell young people what they don't want. And it might not be for me. I might not enjoy hookah, but somebody might like it. Somebody might like a nice [0:56:19, 0:56:39]: Cigar. That's what we do in entertainment districts. It's not for me, but it's not for me to be the person to say, oh, we're not gonna do this. We did studies. And we did, and we collected the information. We had charrettes on downtown to ask people what they wanted to see. They told us what they wanted to see. It came directly from [0:56:39, 0:56:59]: For the public, and it was put into the ULDC and the downtown village program. I don't want to get into this phase, and I hate the word, and I with all due respect, Ms. Moratoriums. I don't like that phase because we're in a position where we're in a growth phase. What we did as a city, we chose to go down the avenue of [0:56:59, 0:57:19]: Distance requirement. There's a nail shop over here, right? At the in the Food Depot Plaza. There can't be another one within a mile. It's already restricted, right? There's a barber shop right across the street. It needs to be another mile. There's one over here in the Shur and Wizard Plaza. So there can't be another one. So the distance requirement and [0:57:18, 0:57:25]: the measures are working already and as Miss Gann indicated to be overly cumbersome. [0:57:25, 0:57:45]: Sometimes business is about the math and it's about the art and the science. You don't want to put the artists in a box because you don't never know what portrait they might be painting. So anytime someone's doing a project for me and it's involving culture or art, I always like, I don't want to be too specific because I don't want to [0:57:45, 0:58:05]: kill the creativity because I will kill the creativity if I'm trying to put a square uh a round hole in a square pay in a square square box. It's not going to work. But what I'm do what I wanted to do is to we we went up to Avalon to look at what they did in Avalon. We went to the truest mixed use development. [0:58:05, 0:58:25]: Over in Cobb County. We went over to Fayetteville to see what they were doing. We wanted to see, not to see, not to copy what they were doing, but to see best in class development. We've seen that best-in-class development thrive in every area. And let me say this and let me be very clear. [0:58:25, 0:58:45]: Clear as the downtown development authority member. All of us up here have said one thing very clear. This downtown belongs to all of us. And our best interest is no city thrives without a developing downtown. And certainly, and I'm going to say this, and I and I want to say this the right way. Okay, by investing and [0:58:45, 0:58:50]: having the private sector come in, our downtown is moving forward. [0:58:50, 0:59:03]: With all due respect to my colleague, Miss Barber, she voted against every piece of measure that we move forward with up here in the downtown area. 114 would still be a city property because she did not support it. [0:59:03, 0:59:23]: These areas are more deeply than what we're doing here at City Council. They're much deeper than that. It's about the entire area and providing a gathering space. And if we got to be in a position where we're taking the vision and the direction of the community who has told us. [0:59:23, 0:59:43]: What they wanted, not our opinion, their opinions or what they wanted to see to be able to move forward with this. I'm not gonna sit up here and try to say this is what I wanna do. I wanna do what you want me to do. And be doing what you want me to do, we listen to those and gather the information that was necessary to make these projects happen. [0:59:43, 1:00:03]: It would be a transformative project if that three acres was approved and used as mixed use. We've already seen it. It's thriving over there at the bridges at Jodico in Argento. It's kicking off in the Levi that's over there in that area. People are thriving to it. Young people are coming to it. [1:00:03, 1:00:20]: Seniors well appointed or like to see it and like to be able to walk to everything. We're building the vision that you have asked us to do right here in the city. We don't want to turn it around. The property over there, Mr. Anderson, behind the subway and all of that, we voted on that. [1:00:21, 1:00:21]: Right. [1:00:22, 1:00:23]: We did. Mm-hmm. [1:00:23, 1:00:40]: We brought it on a town home community, single family, and already approved it yet on that fifteenth anchor. We're not about to rewrite what we've already done. The program has already been done and the people out there in the in the main street just told us at the last meeting. [1:00:40, 1:01:00]: They're looking for somebody to take some action. They're tired of us talking and kicking the can down the road. They want to see something happen. We hired this seasoned city manager, Mr. Edmondson, to guide us as a former Main Street person to be able to come in and develop this downtown, and that's what I'm committed to doing. Thank you. [1:01:00, 1:01:10]: Therefore. Okay. If I may. Yeah, go ahead please. Okay. I wanted to respond to a couple of comments that Councilman Alexander mentioned. [1:01:11, 1:01:16]: I don't recall opposing any developments in our downtown, however. [1:01:16, 1:01:27]: I have had strong um concerns and resistance to selling our city owned real estate properties without advertising them. I have strong [1:01:28, 1:01:31]: Opposition to selling. [1:01:31, 1:01:34]: city owned real estate properties without [1:01:34, 1:01:36]: getting them appraised. [1:01:37, 1:01:43]: I have concerns that city owned real estate properties were sold below the tax assessed values. [1:01:44, 1:01:45]: Those have been my concerns. [1:01:47, 1:01:51]: When he spoke about the vizits to Avalon. [1:01:51, 1:01:53]: I wasn't on the council. [1:01:53, 1:01:56]: When he mentioned about the council going to Trilliph. [1:01:56, 1:01:58]: I wasn't on the council. [1:01:58, 1:02:01]: So all of those visits and research that they may have done. [1:02:02, 1:02:03]: was prior to me. [1:02:03, 1:02:07]: I didn't get any I didn't get an opportunity to add any input. [1:02:07, 1:02:10]: Into whatever their vision was. [1:02:11, 1:02:15]: Twenty thirteen, whatever the vision was, I wasn't on the council. [1:02:15, 1:02:17]: I don't support crowding. [1:02:17, 1:02:20]: This three acre lot across the street from City Hall. [1:02:21, 1:02:23]: It should remain green space. [1:02:23, 1:02:26]: If you want to develop a mixed use development [1:02:27, 1:02:30]: We have fifteen the city owns fifteen acres. [1:02:30, 1:02:32]: Behind Sherman Williams. [1:02:33, 1:02:36]: All of these properties are within the city council district that I represent. [1:02:37, 1:02:39]: So everybody seems to have a whole lot of [1:02:39, 1:02:42]: um interests in my district and rightfully so. [1:02:43, 1:02:43]: I get it. [1:02:44, 1:02:45]: Rightfully so. [1:02:46, 1:02:47]: But I want us to plan it. [1:02:48, 1:02:49]: The right way. [1:02:50, 1:02:57]: If there were plans or the vision from 2013, it would have included the Rock Quarry Road extension. [1:02:58, 1:03:00]: The Rock Quarry Road extension would go from [1:03:01, 1:03:08]: the Sherwin Williams Plaza, all the way down to Old Conyers Road, where the Publix is, on East Atlanta Road. [1:03:08, 1:03:13]: But yet that project has been put on hold. It's not even on a priority list. [1:03:14, 1:03:22]: So when you talk about a vision and moving forward with the plans, move forward with all of the plans, not just half of it. [1:03:22, 1:03:25]: Infrastructure should be important. [1:03:26, 1:03:32]: Especially in this downtown area in which we all support a live work and play environment. [1:03:33, 1:03:36]: If you're going to build in a downtown area. [1:03:36, 1:03:40]: Invest more in more robes. [1:03:40, 1:03:43]: Not just maintaining what we currently have. [1:03:43, 1:03:56]: That seems to be the pattern here. Just maintaining the roads, repaving, resurfacing, fixing the sidewalks. No, we need new roads. This council has approved nine [1:03:56, 1:04:00]: Nine townhome developments in my district. [1:04:01, 1:04:05]: I I abstained from the votes on all of them. [1:04:05, 1:04:06]: Nine. [1:04:07, 1:04:08]: have been approved. [1:04:08, 1:04:11]: And they want to add this mixed use development. [1:04:11, 1:04:14]: Squeeze it on a three acre lot. [1:04:15, 1:04:16]: It doesn't make sense to me. [1:04:17, 1:04:24]: I'm the only one who is asking us to pause. Let's look at this again. [1:04:24, 1:04:34]: Let's rethink how we are moving forward with I don't know whose vision this is, but let's think about how we're moving forward with um realizing [1:04:35, 1:04:37]: A planned vision for our downtown. [1:04:38, 1:04:40]: That's what I'm asking for in the district. [1:04:40, 1:04:41]: That I represent. [1:04:42, 1:04:43]: In the district. [1:04:43, 1:04:46]: That the residents elected me to represent. [1:04:47, 1:04:48]: The business owners [1:04:48, 1:05:01]: They they want to make sure that they have um access to all uh potential clients coming in. They want to make sure that there's parking, adequate sidewalks. [1:05:01, 1:05:07]: All of that and we make we need to make sure that we have the infrastructure in place for it all. [1:05:08, 1:05:09]: I wanna see. [1:05:10, 1:05:11]: This council [1:05:11, 1:05:14]: prioritizing infrastructure. [1:05:15, 1:05:22]: New infrastructure, not just maintaining what we currently have, as it pertains to convenience stores. [1:05:23, 1:05:23]: Right here. [1:05:24, 1:05:25]: on Rockware Road. [1:05:26, 1:05:28]: There are two convenience stores right on the corner. [1:05:29, 1:05:31]: Right on the corner of Rock Quarry in North Henry. [1:05:32, 1:05:33]: In fact it's [1:05:34, 1:05:36]: One of them, the happy market. [1:05:36, 1:05:42]: It's right next to the fifteen acres that the city owns. There's a new one. There's a new one right across the street from it. [1:05:44, 1:05:45]: So from here [1:05:45, 1:05:51]: To right here at the corner of North Henry Rock Quarry Road, two convenience stores. Not to mention [1:05:52, 1:05:53]: There's also a c a food mark [1:05:54, 1:05:55]: Right down the street. [1:05:56, 1:05:57]: On East Atlanta Road. [1:05:57, 1:06:04]: across from Gardner Park. So there's no shortage of convenience stores. I know my district very well. [1:06:05, 1:06:06]: We don't need another convenience door here. [1:06:08, 1:06:15]: So that is why I'm saying we need to rethink these plans because whatever this vision is. [1:06:15, 1:06:19]: As far as their vision for live, work and play. [1:06:19, 1:06:20]: It's not the same as mine. [1:06:21, 1:06:26]: Cause having a another convenience store in the downtown does not do anything. [1:06:26, 1:06:33]: to help with a live work and play environment when there's already three that are within two miles from each other. [1:06:34, 1:06:40]: I don't support it, not at this time. What I'm asking my councilmates to do, considering this is my district. [1:06:41, 1:06:50]: I'm asking them to allow us to have more robust discussions during our retreat in September. It's interesting that this would come forward. [1:06:50, 1:06:54]: One week after we have a нюменню ситі менеджер да старс. [1:06:54, 1:06:58]: He hasn't had the time to really delve into the details of any of this. [1:06:59, 1:07:00]: He hasn't. [1:07:00, 1:07:01]: So [1:07:01, 1:07:03]: I think that's all the comments that I have. [1:07:04, 1:07:06]: Um everything that I've said [1:07:06, 1:07:08]: Um Madam Clark. [1:07:08, 1:07:09]: It's all for the record. [1:07:10, 1:07:10]: Thank you. [1:07:11, 1:07:12]: Mr. Barrett, please. [1:07:13, 1:07:17]: Yeah, thanks mayor. I I think it's really important for us to kinda [1:07:17, 1:07:23]: take a step back and pause because I've I've kind of been on the council the least amount of time, only a year. [1:07:23, 1:07:29]: And some of the things that we have had at a lot of our retreats have been centered around the downtown development. [1:07:30, 1:07:50]: And we've seen uh plans and we've seen a whole lot of different uh ideas about what we should and what we shouldn't do in the downtown area. And I think one thing um that resounds out of each and every one of those times that we've met is that the downtown district has has been overlooked in the city of Stockbridge for a long time. [1:07:50, 1:08:07]: Long, long, long time. Uh when you poll people when you talk to the residents, the one thing that makes Stockbridge look different than the other cities in Henry County is that it's void of a downtown area that that has the culture and the character of the city. [1:08:08, 1:08:28]: And so Stockbridge being as historically significant as it is in Henry County, we need that central gathering place. Every city needs that benchmark central gathering space that people, the community comes together and galvanizes at that place. I think what everybody's saying is true. [1:08:28, 1:08:28]: [4109.0, 4119.2]: That yes, we need the development, yes, we need the mixed use, yes, we need something that's little work and play, but we also need the green space. And we also need and so they're not mutually exclusive. [1:08:40, 1:09:00]: You can have them all. I d I I don't I don't understand why we we make it as if it's either or. We can have every single one of the things that that all parties are are asking for and coming to the table to really make it the best downtown area that we can have, but there has to be a strategy about doing it. And so I I I think we got to get people. [1:08:59, 1:09:13]: past uh the positions and the points and and just opposing and trying to make, you know, the points and and listen and and hear all the contents that's being said, mix it all in a pot and make gumbo out of it. [1:09:13, 1:09:18]: and and and get the type of downtown area that everybody can have a piece of it. [1:09:19, 1:09:39]: Every piece of the culture can have a piece of it. And and when we can do that work, when we can get be beyond our own egos and our own pride and our own this is my idea and this and this and that, we can serve the people and give the people what they need. Which is a that's that's for me and my passion, that's one thing that I know when I drive down [1:09:39, 1:09:43]: down one hundred eight when I drive down this road. Where where is my downtown? [1:09:43, 1:09:53]: Where where where is that that that beacon of light that that makes hey that I'm in Stockbridge? You know when you hit that spot that I'm in Stockbridge, we need it. [1:09:54, 1:10:10]: We we we owe it to ourselves, we owe it to this council to collaborate, to communicate, to put all the ideas together and foster a sense of community that'll make everybody proud of what we have accomplished. [1:10:11, 1:10:31]: That's what this needs to be. And we don't need to be pressing pause. We need to do it quickly. That's right. Because it's been taking I've been here a year and a half and I've been waiting to see it. And it's taken too long. I don't want to have another meeting. I don't want to have another set of drawings. I don't want to see another plan. I want us to incorporate the things that she said. I want to incorporate [1:10:31, 1:10:40]: The things that they have said, and I want to put it all together and I want to see some dirt move. I am so tired of talking, and it's time for some action. [1:10:41, 1:10:50]: Please, let's let's take all of these great ideas and put'em in a cornucopia and make us a nice meal out of it and have the best downtown in the in in the south. [1:10:52, 1:10:52]: Major. [1:10:52, 1:10:53]: That's that's it. [1:10:55, 1:11:11]: One second. Okay, Miss Cant, go ahead, please. Well, um I just wanted to reiterate that and I agree with Councilman Bear. I used to always say that, um, Councilman Berry, I want to see some dirt moving. I need to see something. Let's get it moving and shaking. And um [1:11:11, 1:11:12]: I agree. [1:11:12, 1:11:13]: Um [1:11:14, 1:11:31]: We do have a plan with infrastructure. We've implemented some of those plans already. And we also have a master trail plan that actually starts in our downtown area. Um so we have a sidewalk plan, we have funding that we have implemented towards that, and we have other things. [1:11:32, 1:11:41]: you know, in the making, but it's time to get started now. Now I just want everyone to know that this just we're putting things in play [1:11:42, 1:12:02]: But that doesn't mean that we're still not w we would still be in negotiations and we would still be talking to whomever the developer would be or whatever the case may be in regards to what a building would look like and what businesses would go there. This is n this is just us saying, these are the things that we don't want in our downtown area. [1:12:02, 1:12:12]: This helps us from the ground zero surfacing part, has nothing to do with the building or anything else. I think we've gotten ahead of ourselves. [1:12:13, 1:12:31]: I wanna thank our staff. Um, I wanna thank you, Mr. Anderson, you and your team, your planning, your uh your whole team for providing us with the tools necessary to get started, to at least lay the groundwork and limit some of the things that need that we need to limit. [1:12:31, 1:12:51]: So that we can go ahead and start implementing plans and we can talk about any of those plans during the retreat. But right now, this is this is just legwork on saying what businesses can and cannot come in our downtown right now. And I am all for it if it's getting us from point A to point A and a half. But I I just need us to go. [1:12:51, 1:13:11]: To get those steps, and this is a baby step compared to some of the other things that we need to do. Um, in regards to green space, it's been again the LCI plans out for that, the RSVP plans out for that. Believe it or not, folks, some of you may or may not know this, but we have community involvement all the time. [1:13:11, 1:13:31]: We don't just sit here and make these decisions. We paid a lot of money for studies in the past. And those studies have been done in churches. Those studies have been done in our community center. Those studies have been done down at our Merrymanders. We've asked people for their input. We've asked the community for their input. We've asked organizations. We've asked commun for [1:13:31, 1:13:41]: and committees. And I'm one hundred percent with you, Councilman Berry. It's time to move the dirt. It's time to get things started. And we are ready to get started. [1:13:43, 1:14:03]: I just wanna say one thing. I just wanna uh I Miss Gantt uh kudos and thank you a round of applause'cause I I wanna see something happen, Councilman Berry so bad I don't know what to do. Every time I go to the D D A meeting I'm getting beat up. They're saying Mel m Miss Alexander, when are we gonna do something? When are we gonna do something? I go to the main street, when are we gonna do something? When are we gonna do something? [1:14:03, 1:14:03]: Yeah. [1:14:04, 1:14:23]: But I'll tell you what we did do, we spent millions of dollars on stormwater infrastructure in the amphitheater. People talk about the project, the building itself, but there's three stormwater facilities built for the expansion of downtown in the amphitheater project. So stormwater has already been taken into consideration. [1:14:24, 1:14:44]: Did you notice the three million dollars that we spent around City Hall? Did you notice the new, not just Turn Lane, the lane that extends from North Henry Boulevard all the way down to Bryant Street? That pi uh for years there was a bottleneck there where people wanted to turn right where they had to wait for [1:14:44, 1:15:04]: You know, mi uh 30 minutes to turn on a bit at a busy time or during a city event. The infrastructure is all of these street lights that you see around here and the storm water and the facilities have been added. And Mr. Edmondson has been charged with moving the downtown alleyway project forward. [1:15:04, 1:15:12]: And bringing that information back to us so we can move some dirt. And kudos, Mr. Berry. You've said it all. I don't need to say another word. Thank you. [1:15:13, 1:15:13]: Mm-hmm. [1:15:15, 1:15:27]: Make this a last comment, please, so we can move on. I'm sorry. Make we'll make this a last comment so we can move on. Okay. Go ahead. No, I wanted to ask, um, your list uh prohibited uses in the D T V [1:15:29, 1:15:35]: Um if the council is amenable to adding the additional uses that I listed. [1:15:37, 1:15:41]: And also adding as a condition of this as well. [1:15:43, 1:15:47]: Um adding the extension, the Rod Quarry Road extension. [1:15:47, 1:15:50]: to our current pro um priority list. [1:15:50, 1:15:52]: I want to see that moved forward. [1:15:52, 1:16:02]: Otherwise can't realize the true value and potentials of our downtown. I don't want us to just keep building on top of buildings and we're all just [1:16:03, 1:16:04]: Everything is just [1:16:04, 1:16:08]: Concentrated to one area. [1:16:09, 1:16:12]: Our downtown, if you're looking at the map, is expanded. [1:16:12, 1:16:13]: Beyond [1:16:14, 1:16:18]: Честі в амфатер із вифтині екс. [1:16:19, 1:16:21]: Down further where Gardner Park. [1:16:22, 1:16:33]: There's a whole lot more areas that we need to make sure that we are developing, not just the area that is central to City Hall and the Zampitheater. [1:16:35, 1:16:55]: That's all. But I want us to include all of the um uses that I mentioned to your list of prohibited uses out of this D T V overlay. So you want to add those that need to be that's a one second. You want me to list the other thing. Yes, if I may. All right. So she's making a motion for that. [1:16:54, 1:17:14]: hearing um i'm sorry after public hearing because i know i still got to do that but uh um uh mayor the the intent of of the of this um text amendment was was basically just to line up our udc our zoning ordinance with our studies that we currently have on the record so we got all these studies making [1:17:14, 1:17:34]: recommendations on different things we should do that we paid for in the past in the downtown area, but they can't be done because they conflict with the unified development code. So most of that stuff is outside of my jurisdiction as falls under economic development. So I'm just trying to line it up so they can do their job. Okay. This is a second reading. Is it I forgot, is there a third reading we need on this? Uh no, sir. [1:17:34, 1:17:54]: Okay, so otherwise the intent is after the second reading of public comments for us to vote one one way vote anyway. Yes, sir. Okay, all right, all right, good deal. All right, so if I may, I just we just want to reiterate this is being more restrictive in regards to special uses. And these items that we're talking about is actually allowing that any and everything can't be down there without [1:17:54, 1:18:14]: Going through you all to get a special use permit. So it's not open it up to any and everything, it's actually being a little bit more restrictive because things that typically wouldn't require a special use permit now is going to require a special use permit. And those are the gas stations, the automotive repair shops, car washes, convenience stores, and other associated uses. So they're going to require [1:18:14, 1:18:34]: To come to y'all for a special use. Cause right now, without us passing this ordinance, they can go tomorrow and get a license, there's nothing we can do about it. So it's actually being more restrictive. Correct. If I may, to add that in there, just to clarify. But I wanted to include some additional uses to that list of restrictions. Additional restrictive uses. [1:18:34, 1:18:37]: Is that what you're saying? Correct. On a prohibited list? [1:18:38, 1:18:58]: Uh well let's make it clear. I don't support the support with the public hearing and then we can come back and continue our discussion. And so you're saying you're trying to add to this list, ma'am, if we understand you correctly, and what was that what you were trying to say I wanted to convenience stores. This only So okay, so they will have to come get a special use permit right now if we pass this ordinance. [1:18:58, 1:19:02]: They can't get it on their own right now. They will have to come before y'all to get it. [1:19:02, 1:19:05]: I don't want them to be able to come and [1:19:05, 1:19:09]: I don't want them to have the ability to come before the council. [1:19:09, 1:19:16]: And request a special use permit. I want the distance requirement that we already have in place. [1:19:17, 1:19:28]: Right. So so for clarity, just just so you're aware, even if something is on the prohibited list, they have a the option to come before y'all anyway and request it. [1:19:28, 1:19:35]: Just because they're not on this list don't mean they can never come before this body to re request a conditional use or a special use outside of what's prohibited. [1:19:36, 1:19:38]: They always can come before the body and acts. [1:19:38, 1:19:47]: Okay, so what is the purpose of this list then? So anyone that wants to run a adult entertainment establishment, they can come before the council and ask for a special use permit? [1:19:47, 1:20:07]: They can. They don't mean it's gonna get approved, but this is right here so that day-to-day operations that we understand that these things are prohibited and therefore it flags them a process to go before a board, get the recommendation of a board, then come get staff recommendation, then ultimately come before you all to make a final decision. Well, I wanna add to this list of day-to-day operations. [1:20:07, 1:20:10]: To include convenience stores, include [1:20:11, 1:20:17]: Um nail shops, barber shops, hair salons, vate shops, storage facilities. [1:20:17, 1:20:18]: And [1:20:19, 1:20:39]: Yeah, all of those. But we'll get back to that. I want us to move forward with the public hearing and then at the end when the council will voice. And we will ask and that would be the motion. So yes, uh they already jotted it down. So what'll happen is after the public hearing it comes back and then we vote on that, then we'll make the motion with those things and then council could vote on it uh as is or with [1:20:39, 1:20:41]: With those added items. Thank you, sir. Yes, ma'am. [1:20:42, 1:20:55]: Okay, on that note, then I guess we open the public hearing. So uh anybody on in public well once again, we're in a public hearing. So anybody on the on the left side if you have any comments for what has been stated already. Comments for anybody on my left side? [1:20:56, 1:21:14]: Anybody in the middle wants to make any comments? Four. Four. Okay, come on. Why don't you line up on this side, ma'am? Just looks come on. Just line up, stand right there. Anybody on my far right, the comments four. What's been already stated thus far. Okay, come back over here. Anyone else? All right, these are four. Four. [1:21:15, 1:21:23]: Okay. Anybody else? All right. So right now it's looks like three individuals four. Come to your what's good a mic, please. Name and address. [1:21:24, 1:21:25]: And make your comments. [1:21:27, 1:21:47]: Hello, my name is Karina uh Singh. I live in one one three seven Hempel Road. Um I actually work for the city of Morrow, y'all's neighbors. So I think I have an interesting take on I guess this whole thing. Um with us, we're also trying to I guess make our downtown [1:21:47, 1:21:56]: More mixed use and uh trying to attract obviously young people into our city, and I live here so. [1:21:56, 1:22:11]: I'm a young professional. I just graduated college and I think it'd be really nice to have, you know, like bar spaces. Like I don't wanna drive all the way to like Duluth to go get drunk at a bar. And obviously I'm not, you know, going to get drunk at a bar, but [1:22:12, 1:22:15]: You know, like it's nice. Like I'm twenty two, I don't wanna be [1:22:17, 1:22:23]: all the way up there or like all the way in Fayetteville, like it'd be nice to have some spaces for young people. So [1:22:23, 1:22:29]: Stand by. Did you get her f n name? I didn't think you get her name. Which uh she needs your name, please. Yeah. Uh [1:22:29, 1:22:31]: Uh do you want me to write it? [1:22:32, 1:22:38]: You wanna write it down? You need to put it in the mic. Okay, fine, okay. All right. Next please. [1:22:41, 1:22:42]: Name and address. [1:22:45, 1:22:50]: Hello, Mayor and Council members. Thank you for allowing me the opportunity to speak. [1:22:51, 1:22:58]: Um, I would like to say that as a citizen of the downtown area since nineteen ninety one. [1:22:59, 1:23:01]: We do need improvement. [1:23:01, 1:23:02]: We do. [1:23:02, 1:23:03]: However [1:23:04, 1:23:06]: I think we should be very cautionary. [1:23:07, 1:23:08]: about the way we move forward. [1:23:09, 1:23:14]: Because in my personal citizen voter view here. [1:23:15, 1:23:21]: It seems to me like we are just ramming things through in the downtown district like [1:23:21, 1:23:22]: Townhouses. [1:23:22, 1:23:24]: Apartments. [1:23:24, 1:23:27]: There are two smoke shops within two blocks right here. [1:23:28, 1:23:31]: There are one, two, three, five. [1:23:32, 1:23:36]: four, five convenience stores within one mile radius. [1:23:38, 1:23:41]: There are gas stations. [1:23:41, 1:23:45]: Out the kazoo. Tire stations. [1:23:46, 1:23:59]: Much of that looks like eyesores. And one of the newest smoke shops shops I was excited when I saw Food Mart. I thought, oh Food Mart. When I got past the the red light, it said smoke shop. [1:23:59, 1:24:09]: Food mark and s food mart and smoke shop. You know, really, really, that that's that's not a good look. It really is not a good look. [1:24:10, 1:24:30]: And I would like to ask you all to combine your ideas. You have common ground. You all have good ideas. There's nothing wrong with anything that anyone says. The conservative that wants to keep everything the same, the liberal that wants to change everything. Everybody is equally important. That's what our foundation of our [1:24:30, 1:24:32]: републік вас фоуд он. [1:24:33, 1:24:34]: Come together. [1:24:36, 1:24:37]: Get it together. [1:24:38, 1:24:40]: And I will remind you respectfully. [1:24:41, 1:25:00]: As a voter and as a citizen, you were elected to represent the will of the people. And I don't hear from a lot of people here at the city council uh coming from the downtown district. And I am speaking up on behalf of a lot of people who I am surprised that don't even know what is going on. [1:25:01, 1:25:03]: Because they are just not involved. [1:25:04, 1:25:05]: Unfortunately. [1:25:05, 1:25:06]: However [1:25:07, 1:25:08]: I respect every one of you. [1:25:09, 1:25:14]: But with due respect, you work for us, not the other way around. [1:25:16, 1:25:16]: Thank you. [1:25:18, 1:25:21]: Okay, uh next uh in in citizen name and address please. [1:25:22, 1:25:42]: Good afternoon good evening, Mayor and Council. My name is Jaden Williams, 151 Misty Ridge Trail. I'm actually the chair of your planning commission. Um, and so I work very well with Ryan and his staff in the community development. So I wanted to first uh echo the sentiments of Councilman Berry because we do have um the text amendment that's before you all, that's kind of strategic, and they worked very well in making sure that they brought that before you in a strategic. [1:25:42, 1:26:02]: Manager to make sure our city is moving towards progress. But one of the major things is also what Councilwoman Gantt said is that this is just a minor step for the major plan. And so I would also just echo the sentiments of some of our citizens that if we're going to bring these plans to the city, especially in the small acres that we have, it's just three. It's not much, but it's something that [1:26:02, 1:26:22]: That we can build a stockbridge-driven downtown, that you all come together and make sure that we can actually bring some quality and not just look at the young professionals because yes, I'm young, uh just like one of our other residents. I came back home. This is home for me. I've been here all my life. Um, I want to make sure that we also are making sure we're making young professionals involved, getting them involved, but also our current residents. [1:26:22, 1:26:31]: residents. So let's not leave them out of that plan. But I'm a thousand percent uh in agreance with this text amendment. I hope you all can vote on it this evening because the staff did an awesome job on it. Thank you. [1:26:31, 1:26:42]: All right. All right. That was four. Okay. Questions and any comments from our far left against, against anything that was been speaking this evening? Against. [1:26:42, 1:26:44]: In the middle, against [1:26:45, 1:26:52]: My far right. Anything against? All right, so we'll close that no comments, we'll close that out. So I guess uh Ryan, come back please. [1:26:52, 1:27:07]: All right, so now uh we got a um we got a um potential mo motion or uh uh amendment to the motion or addition to the m addition to what you presented, I'm sorry. So we need a we need a motion uh and we'll take it from that point. [1:27:08, 1:27:11]: So is there a motion? Yeah. Yes, sir. [1:27:13, 1:27:23]: This what I wanted to do was to go ahead and make a motion to accept the staff's recommendation. Okay. And Mr. Medmuson, will you come back to the podium? [1:27:24, 1:27:44]: Okay. And certainly you have made a strong case that and let me say this again. I don't know how we got on this that we support convenience stores. That's not what we're trying to do up here. Certainly it's not what we want to do. And and let me say this, I had that same question and I still have that same question about the Henry Mart that added the [1:27:44, 1:27:54]: the smoke shop on there'cause I see that the other day.'Cause that's not supposed to be allowed under the PMU. No vape in smoke shops are supposed to be allowed under PMU on the p on the corridor, you know. [1:27:55, 1:28:06]: Council Member, that's not uh it's not a smoke shop per se. It's a convenience store that sells tobacco products. And that's I know, but that's not but that very name indicates that like they sell vape. [1:28:06, 1:28:26]: Or not because again that name i again indicates that they fall under that category which is we have a prohibition on that along major highways. I saw that myself and I said, I don't know how they got away with that because that should not have been allowed. We might need to make them change the name because in essence that is that is [1:28:26, 1:28:46]: Yes, uh that's correct. Um we'll talk to them about changing the sign, but it's you can't go in there and smoke, you just can go in there and buy tobacco products and that's not restricted by code. Right. So if you would have that discussion with them. And uh plus we're working on legislation. I know I we keep coming up with all these legislation, but we're working on legislation. [1:28:46, 1:29:06]: To address that. Absolutely, because certainly that's one thing that I championed to keep them off of those corridors to make sure we were doing that. But this is absolutely appropriate to make sure that these uses come to us. But I don't support being restrictive in terms of the cigar bar and the and the other uses because in the hoop. [1:29:06, 1:29:26]: And all that because even though I want to enjoy it, the young people do like that. And I I don't want to restrict it and be overly restrictive with those types of measures in order to do that. So I'm uh my first inclination is to be able to say the same thing in terms of moving forward with the staff recommendations. [1:29:26, 1:29:33]: And then say nobody up here is trying to remove convenience stores, but the convenience store would have to come to us. [1:29:34, 1:29:46]: to get a special use permit if they wanted to operate under this y it's actually strengthening it to bring the convenience store to us so that no more convenience stores just pop up without coming to us, right? [1:29:46, 1:29:47]: Right. [1:29:47, 1:29:56]: Exactly. And I mentioned the moratorium because there are sometimes where there is gap in legislation where we have some fall through the crack. And if you start seeing that, [1:29:56, 1:30:16]: And trying to get everything caught up to where it's supposed to be, you have that option. I was just putting that out there in the event that some do slip through, because I understand it's a sweet spot as you start uh modifying your legislation. There's instances where things can like that can happen. You look up, you have three before you even voted on it, and you're like, wow, when that happened, because they understand that it's on the agenda, so people [1:30:16, 1:30:25]: Start moving fast. Right. So right now, basically, once we vote on this and pass this, tomorrow the convenience store has to come to us, right? [1:30:25, 1:30:45]: Yes, sir. So w that the in essence delaying this would actually open it up. We probably would need a moratorium if we delayed. But if we went ahead and passed it tonight, then before anybody else would be able to bring a convenience store, a vape store, anything else, they would come to us. And guess what we're gonna do? We're gonna say no, you can't do that. [1:30:45, 1:31:05]: To do on my behalf. So I want to make a motion so that we can go ahead and move forward with this because I don't support those other restrictions. And then kind of to keep it clean, if we want to bring back at a separate opportunity to discuss some additional uh restrictions, we certainly can do that at a later date. [1:31:05, 1:31:16]: to talk about that in detail, but this needs to be done now so a convenience store does not come to us tomorrow. But I don't want to restrict the entertainment district. That would be my current motion. [1:31:16, 1:31:17]: Mayor Ford. [1:31:18, 1:31:19]: Yes. [1:31:19, 1:31:19]: Um [1:31:20, 1:31:27]: May I ask Councilman Alexander as conditions to his motion because I want to approve this. This isn't in the district that I represent. [1:31:28, 1:31:31]: And this council has shown a pattern of making decisions. [1:31:32, 1:31:33]: In my district. [1:31:33, 1:31:34]: That is that. [1:31:35, 1:31:35]: My district. [1:31:36, 1:31:37]: I want to vote for it. [1:31:37, 1:31:39]: Otherwise, I'm going to oppose it. [1:31:40, 1:31:41]: We don't need another package store. [1:31:43, 1:31:48]: There's already one that was trying to come in the downtown that this council voted and approved. [1:31:49, 1:31:53]: We already have a package store up the street. We don't need another convenience store. [1:31:53, 1:31:56]: None of that is going to help people. [1:31:56, 1:32:01]: That's not gonna help attract anybody to our downtown. We have a suggestion for you, okay. [1:32:02, 1:32:05]: In order for me to vote and approve this text amendment, [1:32:06, 1:32:08]: All of the uses that I mentioned. [1:32:09, 1:32:10]: Package doors. [1:32:10, 1:32:14]: Convenience stores, nail salons, barber shops. [1:32:15, 1:32:16]: Chaos Alliance. [1:32:16, 1:32:28]: Tattoo parlance, storage facilities. I'm asking that all of those uses be included in this motion. Otherwise, I will not vote in support of this. [1:32:29, 1:32:38]: We can add those to the special use list, ma'am, with attached to that motion. So when we present the ordinance, it had those things on there f when we sign off on it. [1:32:41, 1:32:43]: And when is that going to come before the council? [1:32:44, 1:32:45]: When you gonna have that change? [1:32:45, 1:32:52]: The next meeting. So the motion, you approve the motion with those amendments on there. So when we create it for signatures, it would have that on there for the record. [1:32:53, 1:33:13]: So that's why I'm asking Councilman Alexander to include in his motion all of these uses that I just mentioned. And then I can support. Listen, the reason that I say that is those uses are already prohibited now under distance limit. They're already there. [1:33:13, 1:33:33]: You can't add another convenience store with the distance requirement. You can't add another vape store with the distance requirement. Your CNL beauty is right here, so you can't add another one in a mile. It's already in there, and then anything else that comes to us subsequently has to come to us for approval. It's already there. [1:33:32, 1:33:51]: Not something that needs to be added into this uh already. It's already there and limited to this. Now, the one that's not the storage facility, I'm o I'm I'm okay with that because that's not on the list already. We don't have anything restricted, storage limits, no distance requirements as of yet. [1:33:52, 1:33:54]: Right. [1:33:55, 1:34:00]: Is it zone for storage facilities? I don't think he's even in the zoning. Right. So he can't even do that. [1:34:02, 1:34:16]: So basically it's already covered. All everything that you just mentioned is already covered. It's just like I just you just want it your way in order to do it, but it's already covered. It well well if I may, if it's already covered, it doesn't hurt us to name it. [1:34:16, 1:34:35]: Okay. Well let's need less move. It's already covered. To name it basically kind of duplicates what we've already done. So okay, in that in that instance if that's the way we're gonna do it. I'm okay with it. But this does not include cigar bars or hookah bars or none of that. Is that correct? [1:34:36, 1:34:37]: Yeah, those gonna be special use. [1:34:38, 1:34:40]: So g so [1:34:40, 1:34:58]: They can be special use. Hookah bars and cigar cigar lounge. Correct. They can be special use. By the time we do one, that's gonna be plenty. I'm just thinking. But I just uh we don't wanna restrict in our entertainment district for something, you know, that people go to. Right. Okay. [1:34:58, 1:35:01]: So what does it look like for a motion here? What what what are we talking about? [1:35:01, 1:35:21]: I'm okay with uh going ahead since Mr. Edmundson has indicated that they're already covered, it's already in there. Basically there's no harm in adding them since we're all the the restrictions are already in place. Correct. I think that makes sense. Well we're doing it with double keel, but certainly we're doing it again. So what's that motion look like? The motion would be uh [1:35:21, 1:35:33]: to approve the staff recommendations with the additional uh language to limit the convenience stores, the storage facility, uh what was the other two? [1:35:33, 1:35:52]: Nail salon, hair salon. Nail salon, hair salon. And barbershop, which are already restricted, but we're gonna make sure that they're listed in particular that they would be in this motion to understand that they're already that they're that they're s covered and be specifically mentioned in the motion. [1:35:52, 1:36:00]: Would you like for me to list all of those uses that I mentioned? True. So that it can be included in the U.S. I wanna make sure that we w we're in agreement with all of them, yeah. [1:36:03, 1:36:10]: Please list'cause I wanna make sure I we we we not putting anything in the I think what we're saying is they're already [1:36:10, 1:36:14]: Limited. We already it already exists. We already have something in [1:36:15, 1:36:24]: Uh, we already have a policy in place that prohibits those things from being in our downtown area. And storage facilities in general. [1:36:24, 1:36:30]: aren't even zoned for the area. And I don't want us to go round and round and round. I know we've got to finish this up, but [1:36:30, 1:36:50]: It's already there. Um, we just w it won't hurt us to add them into the language here specifically as well, so that when us you know someone comes, they would have to get permission from mayor and council. Um so so be it. But so let's let's get a right motion here with everything. I can add all of those conditions. [1:36:50, 1:36:52]: List them so we understand. [1:36:53, 1:36:56]: Okay. Car repair shops. [1:36:56, 1:36:58]: Tower shops, convenience stores, [1:36:59, 1:37:00]: Nail lines. [1:37:00, 1:37:01]: Barbershops. [1:37:02, 1:37:03]: Package stores. [1:37:03, 1:37:04]: Bake sharps. [1:37:06, 1:37:13]: It's not real. Hair salons. Storage facilities. Tattoo parlors. [1:37:15, 1:37:26]: Right. Those would require special use permits. If you get storage facilities. [1:37:27, 1:37:43]: Okay. And the storage facility would be in there. All of those would be required to have special use permits, which is the language that we have in this. And those ones that are specifically mentioned are already covered, but we're gonna have it in the motion anyway. [1:37:43, 1:37:48]: Ms. Alzheimer, you're making this motion? Yes. [1:37:48, 1:37:52]: Does this also include in the motion the distance requirement? [1:37:52, 1:37:56]: The distance requirements are already will remain in place always. [1:37:57, 1:37:57]: Yes. [1:37:59, 1:38:03]: But it's already in place. Right. They were already and they were staying in place, yes. [1:38:07, 1:38:16]: Okay, Miss Okay, Ms. Addison, you made the motion. Is that correct? Yeah, second. And Ms. Camp second. All in favor of the motion, please indicate. And we'll move on. [1:38:20, 1:38:25]: Text amendment, TX uh two zero two five dash zero two citywide, second reading. [1:38:26, 1:38:46]: Council consideration of the text amendment to amend the city of Stockbridge Code of Ordinance is to create a new section to establish supplemental use standards for personal care homes for one to six unrelated one to six unrelated adults to identify zoning districts which uh where such uses are permitted by special use permit. [1:38:46, 1:39:06]: to establish compliance operational and developmental um standards to amend the home occupation section for all other purposes. Mr. Ryan please or Mr. Anderson please once again mayor this is the second reading. [1:39:06, 1:39:25]: Two weeks ago on personal care homes, um that there is a conflict between our unified development code and our city code of ordinances that we wish to resolve uh to be in line to be in compliance with state law to to be in compliance with with state law and regulations in regards to personal care homes. [1:39:26, 1:39:33]: Excuse me. So staff d um developed some regulations and standards to govern personal care homes in the city of Stockbridge. [1:39:36, 1:39:38]: Questions, Council. [1:39:38, 1:39:58]: I was I was just gonna run through the um I know for sake of time, I'm just gonna run through um uh the the the standards and requirements. Um so we're personal care are provided to you can't have no more than six non-family adults. Personal care services include but are not limited to individual assistants with or supervision self-administered [1:39:58, 1:40:18]: Medication, essential activities of daily living, such as eating, bathing, grooming, dressing, and toilet toileting. A personal care home may not provide nursing or other medical service or admit and retain residents who need continuous medical care. They must have an administrator for the household on a 24-hour basis, seven-day a week, three years. [1:40:18, 1:40:38]: 365 or 366 years a day who live on site. Um we're amending section 9.7020 of the Stockbridge Munich Code, which is part nine of part of Title IX for licensing and regulations, provide definitions for day care centers, daycare center, family daycare centers, and group home. [1:40:38, 1:40:58]: but not specifically for the personal care home. So we're adding a definition to that. We don't know if it was an oversight or not, but all rec all jurisdictions that I've ever worked in or or that know of have um allowed for um personal care homes in their jurisdiction by use of a special use permission. [1:40:58, 1:41:18]: So we're adding that to the definition. So we are defining personal care homes are different from daycare centers, family daycare centers, and group daycare homes because they may be used for adults and they are not limited to fewer than 24 hours per day. Personal care homes does not include buildings which are devoted to independent living, nor do [1:41:18, 1:41:29]: Does it include halfway houses, residential treatment facilities, nursing homes, sanitariums, hospitals, or other institutional facilities or rooming or boarding facilities that do not provide personal care? [1:41:30, 1:41:50]: So these are the districts that staff is recommended that personal care homes be allowed in with a special use permit. They cannot open up a personal care home in the city of Stockbridge without first coming before council, getting approval. Staff can't administratively approve a personal care home in the city of Stockbridge. [1:41:50, 1:41:51]: Yeah. [1:41:51, 1:41:59]: So we're recommending the R R, SR, C C R, M F R, and OI. Well, um [1:42:02, 1:42:22]: So here's the development standards. They must have one acre and they cannot be located in a subdivision. They must meet all setback requirements. It has to be a single-family freestanding structure or within a religious facility. In the city of Stockbridge, we're limiting personal care homes to six unrelated. [1:42:22, 1:42:42]: You can have one to six unrelated adults, 24 hour supervision, parking requirements, two spaces per unit, plus one ADA space per non-resident employee. No parking shall be allowed in the front yard setback. Fencing, a six-foot privacy fence shall be installed around the perimeter and on [1:42:42, 1:43:02]: On all sides of the house. Refer to section 3.213 of the Stockbridge Unified Development Code. The minimum house size must be 2,250 square feet. The exterior appearance of any residential structure for which a personal care home is approved shall be maintained as residential and no signs shall be erected on the property. [1:43:02, 1:43:11]: The structural HVAC system must be in good working condition, must be ADA compliance, must have flock cameras installed with a 360-degree coverage around the structure. [1:43:12, 1:43:32]: Uh resident capacity. Um facilities shall accommodate a minimum of one and a maximum of six. Staffing requirements, at least one administrator, on-site manager, or responsible staff member shall be on the premises twenty-four hours per day. The minimum on-site staff to resident ratio is one to two during waking hours and one to six during non-waking hours. [1:43:32, 1:43:45]: Uh curb cut access. Permitted curb cut access shall be from an arterial or major collective. Permanent curb cut may be allowed from a minor collective within a thousand feet of the property line. [1:43:46, 1:43:57]: A minimum fifty feet front building front yard setback is required if it's adjacent to a SR, C C R MFR, or RR. [1:43:59, 1:44:00]: Uh [1:44:01, 1:44:21]: Personal care home must obtain a valid business license from the City of Stockbridge Business Services Division. So we're we're making personal care homes a regulatory business in the City of Stockbridge, meaning that uh our regulatory uh services department or or staff, including Code Compliance, can pay a visit at almost any time. [1:44:21, 1:44:41]: And uh other compliance requirements. All licensed personal personal care homes shall be subject to annual inspections by the city of Stockbridge to verify their compliance with zoning, health, safety, and building codes. Once again, no commercial signings shall be permitted on the premises of a personal care home located in a residential zoning district. Uh annual compliance report. [1:44:41, 1:45:01]: Each personal care home shall submit an annual compliance report to the city. Floor plan submission. They must submit their detailed floor plan to the city, to the planning and zoning, so we'll know what it looks like inside there. Record keeping them. Personal care homes must maintain current records for all residents and staff. The records must be retained for a minimum of three years after the city. [1:45:01, 1:45:21]: The resident is discharged, transferred, or deceased in according with the Georgia Department of Community Health Regulation. Um Operation Manager, each facility must maintain and make an operational policies and procedures manner manual and have it on site and it must be updated annually. Security, they must submit. [1:45:21, 1:45:24]: to the city of Stockbridge a written security plan. [1:45:25, 1:45:45]: The plan shall include emergency response procedures, visitor access protocol, stiff response training, regular maintenance, and position of security cameras for 360-degree coverage, other additional security measures, uh five outdoor cameras, flood light, smoke detectors, and an alarm system. [1:45:45, 1:46:01]: SIS system. Security coded entry doors and monitored entry system is required. Medication storage, they must have medication storage that is restricted from authorized access. Accessibility features, grab bars, and appropriate signage throughout, and emergency exit system. [1:46:03, 1:46:23]: Uh emergency procedures. Staff would address the situation. Well, I'm not gonna go through that for the sake of time. But um as I mentioned, um we've decided to make personal care homes in the city of Stark Brig a regulatory use. And um as a regulatory business, the city shall require reasonable investigation, assessment, [1:46:23, 1:46:43]: The application, a permit fee of$1,500 that cannot be prorated on or after July 1st and valid through December 31st of the year applied. A valid permit may be renewed for a consecutive one-year period. So they will have to come in and get their permit renewed. Additional conditions upon operations to assure the [1:46:43, 1:47:03]: Compatibility with other uses in the vicinity and to ensure public health, safety, and welfare as determined by the city. And you permit and denial. So we're recommending that the city can revoke or deny the application. If the applicant has been convicted of a felony, the applicant is under the age of 21. The applicant made a false [1:47:03, 1:47:23]: Statement in application for a license. The application on their face indicates that the proposed personal care home cannot be operated in accordance with the requirements of this section or any other significant finding. And business services or the city can also revoke their approved permit if the owner or operator of the personal care home. [1:47:22, 1:47:42]: Violates any requirements of this section. The owner or operator of the personal care home is convicted of a felony. Personal care home is not in compliance with one or more of the conditions of its license. Owner of operator has committed fraud in the rendering or of service of fraud or deceit in obtaining this permit. The owner or emplo or any employee has engaged in any fraudulent [1:47:42, 1:47:54]: false, misleading, or deceptive practice in the operation of the facility, the owner, resident or any employee commits any crime, criminal act at the premises holding, and any or any other significant finding. [1:47:56, 1:48:16]: Uh uh let me touch on this. Um like I mentioned previously personal care homes shall be considered regul a regulated business in the city of Stockbridge. The the non-refundable annual fee is based on the gross receipts of the businesses and added with an annual permit, so they must play occupational taxes. Applicants are required to file. [1:48:16, 1:48:36]: File for a personal care home permit within the City of Stockbridge Business Service Division annually. A person or entity seeking to own or operate a personal care home within the city must apply for and receive an OTC. The OTC must be renewed and issued annually. The city may impose additional conditions on the operation of a personal care home. [1:48:35, 1:48:55]: as it deems necessary to ensure its compatibility with surrounding land use and to protect the health, safety, and welfare. A personal care home OTC once again may be revoked if the the owner of this personal care home violates any of the s commits a felony or fraud on his application. [1:48:55, 1:49:15]: And personal care homes must maintain an act active OTC license from the city of Stockbridge. So those are basically the standards and regulations that we came up with to go along with updating section nine, title nine of the City Code of Ordinances. [1:49:15, 1:49:16]: [6557.4, 6558.2]: So [1:49:18, 1:49:21]: All right, counseling questions for Mr. Anderson. [1:49:22, 1:49:24]: Anybody? I do want to. Go write it, please. [1:49:27, 1:49:32]: Well, you know what? This is a public hearing item. Yes it is. I'll wait until after the public has [1:49:32, 1:49:35]: Offer comments. [1:49:38, 1:49:44]: All right. There's no comments, then it is a public hearing. So from far left side, any p comments four. Four. [1:49:46, 1:49:47]: In the middle. In comments four. [1:49:49, 1:49:51]: A far right, and comments four. [1:49:51, 1:50:08]: Yeah, my far left, any comments against what was mentioned. Anything in the middle? Anyb against? Okay, you come on up, sir. We got a line up. Um I'm on the far right, anybody against what was mentioned or in reference to this? Anybody against? Okay. Name and address please. [1:50:11, 1:50:31]: Robert Schuel, two fifty three Shields Road. Okay. This property's directly across from my house. Uh wait a minute. This is uh this is two seventy No no two we haven't got there yet, sir. We're talking about this is a city, this is a citywide Oh I'm sorry. Texas I jumped a gun. Yeah, there is there is a next one coming up, deals with Texas. [1:50:31, 1:50:35]: But we haven't talked about that just yet. That's coming. That's coming. [1:50:36, 1:50:40]: All right, so any in any no no other comments for or against. [1:50:41, 1:50:45]: All right. All right, Sean. I guess uh Sean has something to say here, so uh questions. [1:50:47, 1:50:48]: Just want to make sure. [1:50:53, 1:51:07]: Um, I'll just like to add, uh I don't recall hearing it, but just for the sake of that, uh I will also include that they must have a generator um in the vent there. There's a winter storm and the power goes out due to that care. I think that's extremely important. [1:51:08, 1:51:09]: A generator. [1:51:11, 1:51:12]: Think of that. [1:51:13, 1:51:18]: Well that have to be in emotion then I would imagine. Yeah, well as a condition. I mean as a condition, yeah. [1:51:19, 1:51:26]: All right. So no that comes for or against. All right. So on that note then, if the council [1:51:26, 1:51:27]: And it's [1:51:27, 1:51:28]: Yeah, yeah. [1:51:30, 1:51:42]: Distance requirement. Can you also include that in this text amendment? For what now? Whis w a distance requirement. Oh yeah, we we we have that um the distance requirement is is fifteen hundred feet. [1:51:42, 1:51:50]: Fifteen hundred fifteen hundred feet. Okay. So I can support this, but I would like to see us have a [1:51:52, 1:51:56]: Have us increase the distance requirement to w to five miles. [1:51:57, 1:51:58]: Five miles. Mm-hmm. [1:51:58, 1:52:03]: I say five miles because my dist my district is so elongated. [1:52:04, 1:52:06]: I don't know about anybody else's, but [1:52:06, 1:52:20]: Mine is so elongated. I I want to suggest five miles, but perhaps a three mile distance may be good. I would need to check with um legal counsel to see if if if that's feasible. Uh [1:52:21, 1:52:41]: Uh well because there's some other the fifteen hundred feet that um that doesn't help my district. I don't want my district to be oversaturated with personal care homes. Okay. My district is the one that's most elongated, so that fifteen hundred feet may work for the other districts. Okay. It doesn't necessarily for mine. What [1:52:41, 1:52:43]: What about uh our standard? One mile. [1:52:44, 1:52:45]: That we've already [1:52:46, 1:52:49]: How about three? Three miles. Okay. [1:52:50, 1:53:03]: Okay. All right. Um Mr. Hetmuson. So otherwise this is something that would have to be in the the motion to approve, the septis, whatever the distance required would be. [1:53:04, 1:53:06]: One mile, three miles, six miles. [1:53:06, 1:53:08]: I I I would say this. Um [1:53:09, 1:53:29]: Just listening to the restrictions that we put in place, it's gonna cost about a hundred thousand dollars just for them to get off the ground besides obtaining all the other permits and license. I think the city went above and beyond and put a lot of restrictions. But we also don't want to make sure that we're not adding such restrictions that we are a bit it's a deterrent, right? Because it is [1:53:29, 1:53:32]: [6815.0, 6816.4]: Okay. Okay. [1:53:39, 1:53:41]: Go ahead, son. I'm sorry, sir. [1:53:41, 1:54:01]: Yes, sir. Uh I was just, you know, saying with all the restrictions that we put on there from them having a digital keypad, the fence, the three sixty cameras, the generator, uh the parking spaces, I mean it's a lot. Um and I think with those in place, it's very unlikely we [1:54:01, 1:54:15]: We probably get a lot of those. I think with the restriction we have in place, I think it's fair to say, hey, we we're not trying to fully restrict, but we are trying to control. I think the restrictions we have in place is reasonable. Um [1:54:16, 1:54:32]: That's a that's a lot. I mean, that's gonna be about a hundred thousand dollars easy just with those modifications inside that we're not even talking about inside the home. Uh it it takes a lot to start one of these things and I just don't think there'll be an influx of those. But once again, if they are. [1:54:33, 1:54:50]: they have to come back before you to get a permission anyway. So it's not like, you know, once this passes that they don't have to come back before this body. They do. They have to state their case. And these are some of the things that you can consider uh or deliberate on before you make a final decision to allow them a special use permit to to operate. [1:54:51, 1:54:59]: Stand by. Sir. You wanna continue on? Please, if I may. Go ahead. Um, because that fifteen hundred feet [1:54:59, 1:55:02]: distance requirement, it may be [1:55:03, 1:55:05]: Fine for the other districts. [1:55:05, 1:55:10]: But not mine, because my district is so elongated. [1:55:10, 1:55:12]: The landmass is much wider. [1:55:13, 1:55:14]: And I don't want [1:55:15, 1:55:18]: My district saturated with a whole lot of personal care homes. [1:55:18, 1:55:24]: We have the downtown area right in the middle of my district. So it makes it a little complicated. [1:55:25, 1:55:35]: Um so I want to extend that distance requirement. I will make a motion um for this if the council uh supports a two mile [1:55:36, 1:55:39]: distance requirement and [1:55:39, 1:55:39]: Um [1:55:41, 1:55:42]: And maybe I overlooked it. [1:55:44, 1:55:51]: Not having personal care homes inside of HOA subdivisions. Yeah, that's it. Okay, so it's just outside. [1:55:52, 1:55:53]: Neighborhoods. [1:55:54, 1:56:14]: One and one acre lot. So that's not a lot of parcels kind of like that that meets this kind of it's very limited. Uh so I think it's restrictive, but once again, um it's up to y'all to add that okay additional restriction. I so the fencing, it has to be full fencing. Yep. [1:56:14, 1:56:15]: Um [1:56:16, 1:56:21]: Can we make that wrath iron fencing because just a regular [1:56:21, 1:56:24]: Like fencing, it falls over. [1:56:24, 1:56:29]: I've got a lot of that in my district and I want to kind of [1:56:30, 1:56:36]: Increase the quality of the fencing. I don't just want anybody to just put up just a regular [1:56:36, 1:56:38]: Either wooden fence or [1:56:39, 1:56:44]: What he called a little chain fence. And I've got a lot of that in my district. [1:56:45, 1:56:47]: So help me. Okay. Um [1:56:49, 1:56:52]: That's one. And let's see. [1:56:57, 1:57:03]: Uh okay, parking on the lawn is prohibited. So the length of the driveway will have to cover that. [1:57:04, 1:57:05]: Um fifty feet. [1:57:07, 1:57:10]: The fifty feet setback. Okay. [1:57:10, 1:57:10]: Um [1:57:13, 1:57:18]: Is it too much um with adding um speed bump? [1:57:21, 1:57:41]: Well, that's uh typically traffic common is a process for traffic common. That would require a study to be done and and for council to vote on traffic common and'cause then that also affects public safety as well. So I'm not saying it can't be done, but for us to decide that tonight, we will have to look at the scenario'cause I think it's not a one size fit all. [1:57:40, 1:57:46]: depending on what the location of these particular houses. So we would have to take another look at that, I would say. [1:57:46, 1:57:50]: Okay. The reason why I want to make sure that [1:57:51, 1:57:52]: Alvis [1:57:53, 1:57:55]: Our document is because we have [1:57:56, 1:57:57]: a [1:57:58, 1:58:01]: Applicant that has submitted a application. I want to make sure that we [1:58:01, 1:58:21]: cover this for any additional or potential right um applications that may come forward. Um and and that will be the a discussion, right? So depending on the location now that you have about it I better idea where this proposed housing is gonna be located, then we have a opportunity to look at that location and see if those things can be added on there or they open [1:58:21, 1:58:29]: open to it because we just don't know right now. Uh because it's, you know, situation dependent, I would say, when it comes to traffic calming, et cetera. [1:58:30, 1:58:30]: Okay. [1:58:31, 1:58:32]: Mayor. [1:58:34, 1:58:37]: Stand by, please. Yeah, go ahead, Ms. Camp. [1:58:37, 1:58:38]: Oh thank you [1:58:38, 1:58:45]: Um, I'm I'm okay with the one mile radius, like all the rest of the restrictions. If you really look at it, you got um an acre. [1:58:46, 1:58:53]: um lot that's very rare nowadays here. Um, if we can even get people in a acre lot. [1:58:53, 1:59:13]: I guess one of my questions was how is b like housing? Um, is it one one senior per bedroom or or is that the requirement or how how does that work? I'm just curious as to know how that is. Um so we make sure that there's no that I know there's a limit. [1:59:13, 1:59:31]: I thought I saw up to six. And the house the full house, but how many bedrooms are required um in order to run this type of establishment with with six or is it one per bedroom occupancy or is two per bedroom occupancy? [1:59:31, 1:59:40]: Okay. Um i is there a certain size the bedroom has to be with that and all those that were in the requirements are in there? I just wanna make sure'cause I [1:59:40, 2:00:00]: Just want to double check. So these these uh housing or these buildings has to be in compliance with the United Building Code as well, residential code for for housing, for safe egress and e ingress as well. So it's not like they can't throw up a bunch of rooms and stick a bunch of people in there. So uh and that's another reason why we put inside [2:00:00, 2:00:12]: the recommend uh the requirement that they submit plans so that we can see the layout to make sure it's still in compliance with uh the building code as well. And and I appreciate that. And um in regards to [2:00:12, 2:00:13]: I'm not [2:00:13, 2:00:33]: really in favor of speed bumps on a private driveway. It's a private road, a private I mean a private property, so to speak. Um it's just a it's private property. So, you know, parking, it's you're going up a driveway, I don't think that's really necessary. Um, but I do think that um, you know [2:00:33, 2:00:40]: No, I just wanted to make sure those requirements are met. [2:00:40, 2:00:48]: I mean, based off of the square mileage of our city, that, you know, just putting the one mile restriction like we do everything else, I think, would be sufficient. [2:00:51, 2:00:52]: Okay, any other comments? [2:00:53, 2:01:13]: Yeah, I I think the one mile restriction would be uh appropriate for for the um for this particular circumstance. I just wanted to make sure that in a residential area that the parking was going to be um adequate for it. And I think Miss Gantt answered my question about um [2:01:13, 2:01:33]: You know, if you got six people in there and you know, the square footage on a house, if you got six people in there and a twenty two hundred square feet house, it might be a little bit tight with two people in each bedroom. So the restrictions on what the size of the house and and everything to make sure that [2:01:33, 2:01:53]: you know, that there's appropriate space uh in terms of ADA accommodations, all that stuff matters. Right. And and and and the you know the compliance e the ADA compliance and all of that. So certainly that would need to be appropriate, but the one mile restriction, there are certain areas in the city where you don't want to [2:01:53, 2:02:13]: Where it's going to be appropriate at. So I wouldn't want to do a five-mile restriction on this or or an extended one. I would want to do the one mile because it's going to be a need in the area. I just want to know a lot a little bit more about it in terms of you we say the residents. [2:02:13, 2:02:20]: uh the resident what the and uh may maybe the after can talk about what the resident population looks like in the facility. [2:02:23, 2:02:36]: Or maybe someone could talk about the re what what is the clientele look like? What what is the the the the the the users look like? Uh what does that represent? Uh w we'll get to that when we come up with the rezoni. [2:02:37, 2:02:40]: I'm saying in general with the population that uses these facilities. [2:02:41, 2:03:01]: Um like maybe um disabled veteran or uh a disabled individual, someone who can't fully take care of themselves but they are dependent, but they still need a little assistance, maybe with getting dressed or using a bathroom or something like that, toilet. [2:03:00, 2:03:03]: We we identified the the uses in the in the presentation. [2:03:04, 2:03:24]: Okay. I I I just wanna to understand'cause I looked at it and I said as it says there was no there wasn't gonna be anyone that would w would we be independent living or assisted living. No, it's not n no, it's not assistant living or they're h they're healthy individuals. They just might forget to take their medicine or something like that. [2:03:24, 2:03:25]: Okay. [2:03:25, 2:03:45]: All right, well that that sounds appropriate for what we're trying to do, um, and uh and understanding'cause the language is kinda complex, it's kinda cumbersome to read it all and just to try to take it all in to see.'Cause you know, a couple of weeks ago we had a situation where we had someone wander off and we spent an extended amount of time [2:03:45, 2:03:54]: in a search for that particular individual, search thank God that they were found safe. So that's not the population that would be targeted for this particular [2:03:55, 2:04:06]: Um no sir, I don't think that's a good idea. This particular use? No, sir. No. Okay. No. You have any comments, sir? Yeah, for you. Okay, so [2:04:06, 2:04:11]: All the other districts have s HOA subdivisions in them. [2:04:12, 2:04:13]: Mine does not. [2:04:14, 2:04:17]: Mine is majority neighborhoods. [2:04:17, 2:04:19]: Well, except for the subdivision [2:04:19, 2:04:20]: The half. [2:04:21, 2:04:24]: The one half of my subdivision that I represent. [2:04:25, 2:04:28]: Ninety five percent of my district is neighborhoods. [2:04:29, 2:04:31]: The rest of their districts have HOA. [2:04:32, 2:04:35]: Neighborhoods and apartment complexes. [2:04:36, 2:04:39]: That's why the distance requirement is important to me. [2:04:40, 2:04:43]: So when when it comes to the distance requirement. [2:04:43, 2:05:03]: I'm amenable to two miles, but definitely not fifteen hundred feet or one mile. The thing is what when I said five or two, three, four, or five probably wouldn't work because I'm not sure your your district exceeds six total square miles in area. So that means you wouldn't baby [2:05:03, 2:05:23]: To have another one in your district, period. You would just only be only able to have this one. So a one-mile distance requirement would be more appropriate. You only have like six total square miles that make up your whole entire district. Uh the city is 20 square miles. The whole entire city of Stockbridge is 20 19 point something total square miles. [2:05:23, 2:05:35]: miles. So that means we could have four in the whole entire city if we went with five. But your district is slightly over five square miles. So that would mean you you would only be able to have this one if you approve it. [2:05:35, 2:05:39]: So I beg to differ if you had a map. [2:05:40, 2:05:42]: Of my district, um [2:05:42, 2:05:44]: It's a lot wider. [2:05:44, 2:05:48]: than six miles. In fact, my district is [2:05:48, 2:05:53]: Фардессах аварс фарде сад іст аварсі [2:05:53, 2:05:58]: All the way farthest north of our city limits, and everything in between. [2:05:59, 2:06:00]: So [2:06:00, 2:06:03]: No. Having um [2:06:03, 2:06:06]: A personal care home every one mile. [2:06:07, 2:06:09]: That that's not feasible. [2:06:09, 2:06:12]: Of course they are okay with it because it doesn't affect their district. [2:06:13, 2:06:18]: Because all of their districts have apartments and HOA neighborhoods in which [2:06:19, 2:06:30]: Your recommendation restricts personal care homes in HOA neighborhoods. So they don't really care. So it's it's correct, it's every square mile, not every mile. [2:06:30, 2:06:31]: Square mile. [2:06:31, 2:06:34]: Square mile. Square mile, not every mile. [2:06:35, 2:06:35]: Thank you. [2:06:36, 2:06:36]: Yes, ma'am. [2:06:36, 2:06:37]: Thank you for that. [2:06:37, 2:06:38]: Okay. [2:06:43, 2:06:44]: But I still want to increase that. [2:06:47, 2:06:51]: Can we still increase that to two? Two, please. [2:06:51, 2:07:11]: Please. Oh well I'll make the motion. Can I make a motion and see if my councilmates and see what see what the rest of the council has to say? Okay. So I will make a motion to approve staff recommendation um for the text amendment TX dash two zero two five dash zero two. [2:07:11, 2:07:12]: City wide. [2:07:13, 2:07:33]: To amend the City of Stockbridge Code of Ordinances to create a new section to establish supplemental use standards for personal care homes for one to six unrelated adults, to identify zoning districts where such uses are permitted by special use permit, to establish compliance. [2:07:33, 2:07:47]: operational and developmental standards to amend the home occupation section and for other purposes, including the condition of the distance requirement of two square miles. [2:07:48, 2:07:51]: Is there a second? Mayor. Yes, ma'am. [2:07:55, 2:07:58]: Yes, and the generator. And to include the generator. [2:08:02, 2:08:04]: You have a question, sir? I would go ahead. [2:08:05, 2:08:25]: Uh to Councilwoman Barber, I just wanna pose a question. Is is it a possibility that we can go back to the one square mile? My my only concern is I don't want us to look like we're so restrictive to a population that's already underserved and underprivileged when we talk about personal care homes. And I think [2:08:25, 2:08:45]: When we make an abundance of restrictions, it sends a mixed signal. I know we don't want to have them, you know, so many within that square mileage. And I think what they've offered is a good alternative. But I think when we make so many harsh restrictions on a vulnerable population, it's a bad message for us. [2:08:44, 2:09:03]: As a counsel to say, hey, we don't want that vulnerable population to live in the city of Stockbridge by these harsh restrictions that we put in. So I I'm not saying that, you know, it's it's bad, but I just kinda tone it back a little. Can we I understand exactly what you mean? And I can agree with that, but um [2:09:04, 2:09:08]: Let's consider redrawing these district lines because what was left [2:09:09, 2:09:20]: when everybody else had input in drawing their districts, they left me what was left. I inherited from the So all of the areas that are vulnerable, all of the [2:09:20, 2:09:24]: Во сам одіс арез, арес да [2:09:24, 2:09:26]: Require a lot of rehabbing. [2:09:27, 2:09:29]: And infrastructure improvements. [2:09:29, 2:09:33]: That's the areas that I have, and what I don't want to do is oversaturate. [2:09:34, 2:09:35]: My district [2:09:35, 2:09:36]: With personal care homes. [2:09:37, 2:09:39]: The undesirables um [2:09:39, 2:09:40]: Bad. [2:09:40, 2:09:41]: The rest uh [2:09:41, 2:09:51]: their districts won't even allow because they are in HOAs and apartment complexes. So it only affects mine really. I'm sorry, point of order. [2:09:52, 2:09:55]: Please do not refer to this population as the other. [2:09:56, 2:10:02]: Can you please add that to my condition? Well, it's fencing. The fencing there is typically. [2:10:02, 2:10:22]: Roth iron. If you can add that as a condition to my motion too, please. That's expensive. Roth iron? That is very expensive. Well, is there another type other than just a chain length chain fence? Rhod iron fence. Privacy fence. What is privacy fence? Oh no, those kind of [2:10:22, 2:10:42]: uh deteriorate really quickly. Is there another type of material that kinda is durable that will last? That's that's too extreme. I can't sorry. That's expensive. The rod iron is too expensive. Businesses don't even put up rod iron. I'm not doing because of the cost. It's it's iron is very expensive. [2:10:42, 2:10:52]: Extremely okay, so these are the complex discussions that we have to have for just my district. It's really only affects my district once again. [2:10:52, 2:10:59]: Their districts are mostly HOA managed neighborhoods and apartment complexes in which [2:10:59, 2:11:02]: This really doesn't apply to them, only to mine. [2:11:03, 2:11:14]: They drew my district that way. But nonetheless. I did not um can we just another alternative can we say in the most or you can say or similar in style. Or similar. In style. Let's say or similar. [2:11:15, 2:11:20]: Okay. Are you uh minimal to one mile or you staying with two miles? I'm not getting my motion has two miles. [2:11:21, 2:11:23]: All right, so is there a second to the motion? [2:11:23, 2:11:25]: Is there a second to the motion? [2:11:28, 2:11:30]: No no second to the motion. Motion dies. [2:11:31, 2:11:51]: I will not accept anything more than um Okay. Well is there well with there needs to be a mayor. Yes, sir. Got a motion. Uh make a motion to approve with the one mile distance limit and the generator being established with it. We've established parking and certainly uh as Mr. Edmondson has indicated, the wrought iron fencing and all of that would be [2:11:51, 2:11:58]: more expensive in commerce and this is we're we're at the point where we need to be at so appro motion to approve. [2:11:58, 2:12:05]: Is there a second to that motion? Well well you're not talking about a right arm thing. You say No, I'm saying no wr no right arm. No right arm. Okay. I I second. [2:12:05, 2:12:08]: Okay, Ms. Gantt second the motion. All in favor, please indicate. [2:12:09, 2:12:22]: All opposed. I will abstain, sir. Okay, so it's three zero one motion passed. I'd like to add a comment to my abstention, as I always do. I will abstain because this mostly affects my district. [2:12:22, 2:12:25]: The other districts are all [2:12:25, 2:12:35]: have HOAs and apartment complexes. It mostly affects my district. And I would prefer there be a [2:12:35, 2:12:36]: Um [2:12:36, 2:12:38]: Wider restriction. [2:12:38, 2:12:40]: On these to two miles. [2:12:41, 2:12:43]: With wroth iron or [2:12:44, 2:12:46]: Some other similar fencing. [2:12:47, 2:12:49]: Along with the generator. [2:12:50, 2:12:53]: And everything else that I named in my original motion. [2:12:53, 2:12:54]: Thank you. [2:12:55, 2:13:15]: All right, number four, special use permit case sp two zero two four-03 Council District 4. Consideration of a special use permit to allow personal care home to operate on property 270 Shields Road within an existing single-family detached residence. Applicant agents Sonia John, the property is located at landlock. [2:13:14, 2:13:34]: 70 of district twelve and it contains 1.47 miles, excuse me, 1.47 acres. Mr. Ryan, uh Mr. Anson, please. Okay, Mayor I'm gonna go through this real fast. I got well oh wow, I'm looking at a 57-page report, but um uh since council approved um the previous uh text amendment [2:13:34, 2:13:40]: Staff is recommending approval with conditions provided that the applicant meets all the requirements. [2:13:41, 2:13:45]: That's in the ordinance that we recently but that we just passed. Staff record. [2:13:46, 2:13:51]: Council, any questions for uh this case that Mr. Ryan, Ms. Anderson just presented? [2:13:52, 2:13:53]: Applications. [2:13:55, 2:13:58]: Okay, excuse me. I didn't okay. [2:13:59, 2:14:01]: That's why she was raising her hand earlier, I guess. Okay. [2:14:02, 2:14:04]: Yeah. [2:14:08, 2:14:10]: Name and address, please. [2:14:10, 2:14:16]: Good evening, Michelle Battle with Battle Law, thirty five sixty two, Habersham at North Flake, Tucker, Georgia, three zero zero eight four. [2:14:17, 2:14:37]: How much time do I have? Ten minutes. Um You got time. I'm slightly distressed by the last piece that was just approved, only because um I've helped a number of personal care homes. The fact that the city doesn't have any personal care homes is interesting in and of itself. [2:14:37, 2:14:51]: Um there are many people who need this assistance. We are living in a time where in a minute a lot of folks aren't even gonna have Medicaid. They're gonna need places to stay. A lot of our seniors are gonna need I'm a senior. [2:14:53, 2:15:00]: We're gonna need places to be. Our families are gonna we wanna be around our families. We don't wanna be two or three cities away. [2:15:01, 2:15:08]: With requirements so restrictive that the personal care homes, most of these are ran quite honestly by a lot of women. [2:15:09, 2:15:12]: Women helping women. Women helping women. [2:15:13, 2:15:16]: Mothers, grandmothers, aunts. [2:15:17, 2:15:36]: People that need a place to be because they can't care for themselves in the same way that others can, where they can stay in their homes. I have an aunt that's ninety that's able to stay in her home, but I also had a mother who couldn't stay in her home and she needed a place to stay. [2:15:38, 2:15:40]: I run a non profit. [2:15:42, 2:15:48]: for young adults who are special needs adults who cannot stay on their own. [2:15:49, 2:15:56]: They need a place to stay. They cannot stay by themselves. That is their home for the rest of their lives. [2:15:57, 2:15:58]: Because they cannot [2:15:59, 2:16:06]: They are mentally or physically disabled to the point that they cannot stay by themselves. This is where they have to be. [2:16:07, 2:16:27]: And so as a society, we have a responsibility to the least of those. And when you put such restrictions, then it makes it almost impossible for those personal care homes to afford to be in existence. They're not getting major dollars. [2:16:27, 2:16:31]: Medicare and Medicaid only give a certain amount. [2:16:33, 2:16:34]: Per person. [2:16:37, 2:16:47]: The startup costs that you all have, you know, the state regulates what they can do, how big the rooms have to be, how many people can be in a room. Those are state regulations. [2:16:48, 2:16:51]: So it's really hurtful to me. [2:16:51, 2:17:05]: to hear the restrictions that are being placed and want to put more and more restrictions because we're more worried about distance and how many people are going to be within a s in a square footage than it is about the people who need the help. [2:17:07, 2:17:08]: It's not until it's your mom. [2:17:09, 2:17:11]: Or your aunt, or your cousin, or whoever it is. [2:17:12, 2:17:16]: that needs the assistance and you can't find it and you want them to be close to you. [2:17:18, 2:17:22]: So that you don't have to go two or three cities over. [2:17:22, 2:17:24]: Де хав лес рестричніс. [2:17:25, 2:17:30]: for you to be able to care for your parent or it or or your loved one. [2:17:30, 2:17:33]: So I apologize for being so [2:17:34, 2:17:38]: angst about this, but it is something that I deal with every [2:17:39, 2:17:40]: Day. [2:17:40, 2:17:59]: And I represent people who have these personal care homes. And it gets offensive to me at times when I hear there's more worry about the distance than there are about the people who need the help. They don't want to be in a personal care home trust. Does anybody in here want to be in a personal care home? [2:18:00, 2:18:04]: That's not the place you wanna be, but it may be the place you end up. [2:18:05, 2:18:14]: And you pray that you're able to be near the people who live in your city who are maybe your kids or whomever that you love and that you want to come and see you. [2:18:14, 2:18:18]: And not have to live so far away that they can't even get to you. [2:18:19, 2:18:22]: through the traffic and all the other things that we have going on around here. [2:18:22, 2:18:24]: That being said, the [2:18:24, 2:18:30]: We believe that this place at two seventy Shields is an appropriate location. We meet the requirements. [2:18:30, 2:18:39]: We meet the requirements with regards to the lot size, with regards to the setbacks, with regards to the distances, all the stuff that has been discussed, we meet it. [2:18:40, 2:19:00]: She has been working on this since last year. She had approval for up to three. She now has approval in May of this year for up to six individuals to stay in the in the community that she is trying to develop. She is trying to do something good for people who live in the city of Stockton. [2:19:00, 2:19:12]: Stockbridge who right now there is no personal care home in the city of Stockbridge that allows up to six people. And I don't knew and I when I looked, I don't even know if I saw any that allowed up to three. [2:19:13, 2:19:19]: When I went on the state's website, there are none. So you're not taking care of those people right now. [2:19:20, 2:19:22]: You don't have an oversaturation'cause there is nobody. [2:19:24, 2:19:33]: The way that this is set up now, you have the ability to review just like this one, a special land use permit every time they come through. There's no [2:19:34, 2:19:35]: Байт. [2:19:36, 2:19:39]: Everybody has to come through this process unless I'm missing something. [2:19:40, 2:19:41]: They have to come through this process. [2:19:42, 2:19:51]: So you have an opportunity to look at where it's gonna be at and what the restrictions need to be and if there's anything particular and no different than us here. [2:19:51, 2:20:03]: Um I appreciate not having the wrought iron fence. That's expensive. Even home builders don't want to do the wrought iron fence because it's so expensive to do. Um [2:20:04, 2:20:10]: We believe that again this is an appropriate location. We are in the SR district. [2:20:10, 2:20:11]: Um [2:20:12, 2:20:20]: The site has a long driveway up, so there is plenty and ample opportunity to take cars off the road for parking. [2:20:20, 2:20:27]: Um the home will be um continue to be um renovated. There's um space within the interior. [2:20:27, 2:20:29]: А фордикс резидентс тел битву. [2:20:30, 2:20:30]: Um [2:20:31, 2:20:33]: Фултиме звубикне. [2:20:34, 2:20:34]: Um [2:20:35, 2:20:55]: Um and so we believe that this again makes sense. Um the residents primarily will be seniors. Um there may be one or two younger people. Um when I say younger, that may be 40 or 50. Um you're typically not mixing a lot of different populations together. You're trying to create [2:20:55, 2:20:57]: Крейте а хом пізніс самадіс хом. [2:20:58, 2:21:05]: For some people they may be able to eventually go back to their other homes, but for some, this may be it for the rest of their time. [2:21:06, 2:21:26]: Um and so we ask that you um approve the application with the conditions um put forth by staff. I know that there's some people here I've heard at other hearings that have spoken in opposition or who have questions or concerns, but I certainly hope that we as a society and this city, this is a great city of Stockbridge, you are [2:21:26, 2:21:38]: Doing amazing things here. You want to take care of those who are able to get out and to enjoy and to play and to entertain and all those kind of things. But I ask you to also consider [2:21:38, 2:21:40]: Those who cannot. [2:21:41, 2:21:52]: Those who need assistance, those who need a place to be and feel loved and cared for. Because in a few minutes, there are gonna be a lot of people. [2:21:52, 2:21:57]: who are gonna have their parents in spaces that they will no longer be able to pay for or [2:21:57, 2:21:58]: Афорд [2:22:00, 2:22:03]: Because of what is happening at our federal level. [2:22:06, 2:22:15]: People are not gonna be in the same position. And these personal care homes may be the only place, only options that they have. [2:22:15, 2:22:20]: because of decisions that are beyond our abilities down here. [2:22:20, 2:22:34]: when it comes to the money that is necessary to take care of folks. So I just ask that we consider that as we consider this application. And my client is here as well. If um she'd like to speak, I'm turning the mic over to her. [2:22:35, 2:22:37]: Okay, good evening to everyone. [2:22:37, 2:22:40]: Um I am humbly asking [2:22:40, 2:22:44]: And I have come before you all many times. [2:22:44, 2:22:50]: I have my life saving in this. I had to mortgage my current home. [2:22:50, 2:22:53]: In order to facilitate what I'm doing. [2:22:54, 2:23:05]: I have made all the requirements that you'll ask, except for the um generator that y'all just add on to it. The state has come over twice to my place. [2:23:06, 2:23:10]: To inspect and has licensed me for six. [2:23:11, 2:23:23]: So all I'm asking is the opportunity to service my community as well, because this is part of the community. I am a resident, I pay taxes as well. [2:23:23, 2:23:24]: Um [2:23:24, 2:23:28]: All of us need to leave and all of us will at a point. [2:23:28, 2:23:30]: Need somewhere to be. [2:23:30, 2:23:32]: I can understand right now. [2:23:33, 2:23:33]: Ви [2:23:34, 2:23:36]: Don't think that we will need it. [2:23:37, 2:23:39]: But I can tell each and every one of us. [2:23:40, 2:23:48]: I may be the next one in these wheelchairs, these beds, or whatever they they uh how we accommodate them. [2:23:49, 2:23:53]: So I am humbly asking. I am tired. [2:23:54, 2:23:55]: Of waiting. [2:23:56, 2:24:01]: I am tired of spending everything that I have beyond what I can afford. [2:24:02, 2:24:03]: Just to do [2:24:03, 2:24:06]: what I feel that I was appointed to do. [2:24:06, 2:24:07]: Well. [2:24:07, 2:24:08]: So please. [2:24:09, 2:24:10]: Grant me that opportunity. [2:24:12, 2:24:13]: That's all I have to say. [2:24:13, 2:24:33]: Thank you. Appreciate your comments and uh Miss Battle, your enthusiasm and passion for all this. Um what I what I personally try to do when something like this comes up and look on the agenda, I drive by, get in my car, and I drive by the location. So I did that today as well. And uh what we just passed in a previous [2:24:33, 2:24:48]: previous discussion it uh we talked about security, we talked about a fence, okay? And I have to admit, I didn't see a fence around the property today. That property is f um free sighted fence. Free sighted. [2:24:49, 2:24:53]: Okay. [2:24:53, 2:25:13]: I'm sorry? It doesn't have to be in the front. It doesn't have to be in the front. Well, I have to admit I didn't get out of my car, but okay. I didn't get out of my car. I didn't walk the property. I just I didn't see one. Okay. And the security aspect, I mean, I mean, I like I said, I didn't get out of my car. So you have something that indicates a secure as well? So uh so [2:25:13, 2:25:33]: So Mayor, before we give her a business license, we I will send my t a team out to inspect to make sure that she's in compliance with the ordinance we just passed. All right and if she pass and uh if she meets all the requirements of the ordinance we just passed, then we will issue her a business license. All right. Why okay? So we'll make sure she got it. That's my case there. All right. I'll just leave it alone. Okay, council. [2:25:33, 2:25:34]: Any other questions, concerns? [2:25:35, 2:25:43]: No. Sorry, this is in my district. Go ahead. Um, and I'd like to wait until after public comments before I make a comment. [2:25:43, 2:25:45]: Anybody else? [2:25:45, 2:25:47]: I I just um [2:25:48, 2:26:01]: I don't have a comment. I'm I'm moved. I thank you for this m Mrs. Battle, Attorney Battle for telling her truth and and speaking what others [2:26:02, 2:26:21]: have thought, um and that there's a need. There's a need and and we have a responsibility to make sure that that need is fulfilled within our our community. Um and you know, we had uh years ago I guess some of the restrictions that [2:26:22, 2:26:42]: per s particularly the generator kind of, you know, I think is a good one for seniors in general with m not you know, a generator is important. Um years ago I remember we had uh one of our former solicitors, there was a group home that was being operated illegally. [2:26:42, 2:27:02]: And we were hound there was one in a subdivision one time, and there was one that was at a residence that was not in a subdivision, but it was up being operated legally, and the uh the the uh people that were in there were uh it did not look like as if they were being treated. [2:27:02, 2:27:06]: treated as as needed, but that was taken care of. [2:27:07, 2:27:11]: through the criminal justice system and so [2:27:11, 2:27:31]: The reason why I asked about the bed and and duh, it it ch you know, it's a group home, so uh state regulated. I wasn't thinking, I'm like, well, what about beds and how does that work? But when you in hindsight, when you really think about it, the states come out twice. They've already did theirs, no different than a daycare center or anything else that [2:27:31, 2:27:51]: has to be regulated by the state as well as by us. And so I'm definitely in support um of the need. We have to we can't be selfish and look at just our needs as individuals, but but years to come, our parents, our family members, [2:27:51, 2:28:03]: our loved ones and the need within our community alone. Um and so uh you know I'm for it and um I hope that my colleagues will be as well. [2:28:04, 2:28:09]: Yes, go yes, sir. Okay. [2:28:10, 2:28:30]: Yeah, I I just thank you for yielding. I just I just want to again echo w what I was trying to say earlier is that sometimes we we over politicize stuff and it's really not about the politics of it. It's it's about the compassion. And uh to to see, you know, to see people. I think some [2:28:30, 2:28:50]: Sometimes we see conditions, we see statistics, we see distance, but we don't see people. And and it and it goes against every fabric of who we are as people that when we take a away our ability to serve and to love and to see, uh, we dehumanize ourselves. [2:28:50, 2:28:52]: And it makes us [2:28:54, 2:29:14]: quite frankly, it it it it it makes us demonized to the point to where uh we can't do the simplest thing, which is what we are required to do, is to love one another. To to love one another as Christ loved the church. And I hate to to take it there, but that's who I am and that's the essence of who [2:29:14, 2:29:34]: my character is and that the elderly is a vulnerable population, the mental ill is a vulnerable population. The medically fragile is a vulnerable population. Foster kids, vulnerable populations. Um I can go on and on. Um [2:29:34, 2:29:54]: When we talk about family members who have had uh debilitating situations with cancer, with dialysis, with liver failure, kidney what whatever whatever the thing that you cannot imagine that could ever happen, it can happen. And it can happen at a moment that you didn't even expect it and it can come suddenly [2:29:54, 2:30:05]: and it can change your world and it can rock your family and it can change the whole dynamics of of everything you have as a as a as a person. And my granddad used to say this, he said, [2:30:05, 2:30:07]: If if it hadn't hit you today. [2:30:07, 2:30:08]: Keep living. [2:30:09, 2:30:11]: Keep living. If you haven't met trouble. [2:30:12, 2:30:27]: Keep living because if it doesn't show up today, it's gonna come. And when it comes, the measure of it will not be how you handle it. It will be how you treated others in the condition before you. You can't expect grace when you don't give it. [2:30:27, 2:30:37]: You can't expect love when you don't give it. You can't expect some so so as as a as a council, as a citizen, as a person, as a pastor, as a council member. [2:30:39, 2:30:40]: I got a grandmother. [2:30:42, 2:30:42]: I got a mother. [2:30:44, 2:30:49]: I've worked with foster care with the state of Georgia for over twenty five years, retired from the state. [2:30:52, 2:30:53]: Nobody. [2:30:53, 2:30:55]: Considers the less fortunate. [2:30:56, 2:30:58]: Until they're moving across the street. [2:30:59, 2:31:09]: And we try to figure out ways for them not to be there. And we try to figure out ways where where how can we hide'em? Uh how c how can how can we lock our eyes to like c like [2:31:10, 2:31:17]: Jesus' greatest commandments that what you do to the least you said it earlier, what you do to the least of these, you do also unto unto me. [2:31:20, 2:31:26]: But we like to say that we care about the world, we care about everybody, we care about the condition, the human condition. [2:31:27, 2:31:37]: until you gotta help somebody who's less fortunate. I mean really serve, not just look good on TikTok and on on social media, but when you really gotta serve somebody. Mm-hmm. [2:31:38, 2:31:44]: Then it gets distant and then it gets quiet and then people shrink. [2:31:44, 2:31:47]: And that's not the time to shrink, that's the time [2:31:47, 2:31:48]: To stand up. [2:31:50, 2:31:51]: So I I [2:31:52, 2:31:57]: I wish I could do more from this position and from this place. I wish I could do more. [2:32:02, 2:32:05]: I wish I would not be a You need to come to the mic if you can speak come to the mic, please. [2:32:06, 2:32:10]: I said I really appreciate your opinion and um I wish there was more [2:32:11, 2:32:13]: Who things like you because [2:32:13, 2:32:15]: When we on the other side [2:32:15, 2:32:16]: We don't see. [2:32:17, 2:32:20]: at the back of the fence until we cross over. That's right. [2:32:21, 2:32:22]: And um [2:32:24, 2:32:27]: All the stipulation that has been placed there. [2:32:28, 2:32:30]: It's making things more difficult. [2:32:31, 2:32:32]: More spending. [2:32:33, 2:32:37]: And I don't hear anywhere where anybody will give a grant to help. [2:32:39, 2:32:40]: I mortgage my home. [2:32:41, 2:32:42]: To do that. [2:32:43, 2:32:46]: I left my job to pay my full attention to that. [2:32:46, 2:32:48]: Right now they're leaving on my loan. [2:32:49, 2:32:50]: And um [2:32:51, 2:32:54]: Fixing doing whatever I have to do on this loan. [2:32:55, 2:32:57]: And I have been waiting quite a while. [2:32:58, 2:33:01]: And I'm getting hit with more stipulation to add on. [2:33:02, 2:33:14]: So what I need to know is do I have to add on all the stipulations that you'll add on to what the state has already approved? [2:33:15, 2:33:22]: Or is it moving forward to the next person that has to come up with all those requirements? [2:33:28, 2:33:33]: Because when I first applied, before I applied, when I applied for zoning [2:33:35, 2:33:38]: I was told what was the requ what the requirement were. [2:33:39, 2:33:42]: But apparently that it was not [2:33:43, 2:33:50]: It was not re um it was not allowing it anymore. But I was told what was the re the requirement was. [2:33:51, 2:33:53]: And I am reaching all the requirements. [2:33:53, 2:33:55]: The state have its requirements similar. [2:33:56, 2:33:58]: Similar to what it was. [2:33:58, 2:34:02]: and I'm reaching all the state requirements. Even when they came and inspect [2:34:03, 2:34:04]: Both times. [2:34:05, 2:34:07]: Ай, спок бабде пакін. [2:34:08, 2:34:22]: to to the inspector. And both of them were saying, What what is this? You have ample space at the back of the house. Why would you add anything more to that? [2:34:23, 2:34:26]: And I said, I don't know. That's the first time I'm seeing it. [2:34:27, 2:34:29]: I had a personal care home before in Riverdale. [2:34:30, 2:34:31]: And because most people [2:34:32, 2:34:33]: Ask for. [2:34:33, 2:34:35]: Other side of town. [2:34:36, 2:34:38]: This is why I purchased the home over here. [2:34:40, 2:34:40]: And [2:34:41, 2:34:43]: It's not a whole tailspin to me. [2:34:44, 2:34:48]: But I am willing to comply, but I just need to know [2:34:48, 2:34:52]: where I stand with your new requirements. [2:34:54, 2:34:55]: Prior to what was there? [2:34:56, 2:35:15]: I tell you what I I would imagine, good question. I would imagine we need to get a legal opinion on that as well. We just pa that's why I asked what I did earlier, because we just passed something just now. And I that that I understand that. I understand that. That's why I asked the question. Well, okay. Well, what we just passed. So [2:35:15, 2:35:23]: So I guess what it amounts to, and I don't know if Ryan, you wanna answer that, but I've but I understand Miss Battle's attorney, but also we have our own attorney like to write read in on this. Go ahead, sir. [2:35:23, 2:35:37]: Well uh the question was w whether could she be exempt from the requirements? Well basically b basically that's what she's asking is she's exempt from what we just passed because of what's been going on for the previous years, I would say. I t I I I'll refer to our zoning attorney, but um [2:35:39, 2:35:59]: far as my understanding, if we didn't have the the use in place, we didn't have regulations for it and we didn't allow for it. So the law just got to pass f a few minutes ago. So that means from the few minutes ago to now, um, everybody would have to be in compliance with it. But I'll get with Mr. Edmondson and see what we can do to [2:35:58, 2:36:05]: to maybe help her out, uh until we get a an opinion from Valerie. But [2:36:05, 2:36:25]: Everyone must comply with the with the ordinance. The ordinance just got passed. We didn't have anything on the books addressing it because personal care homes were not allowed in the city of Stockbridge. But we'll we'll do what we can uh after I speak. What part of the guidelines are you having the biggest issue with? What part of the law, the guidelines are you having the biggest issue with? Yeah. [2:36:28, 2:36:30]: question is [2:36:33, 2:36:53]: She had filed for a special land use permit under the ordinance based on the uses that were allowed. The c the city did not have regulations in place to regulate it from a business licensing perspective. So I think the question to your legal counsel. [2:36:53, 2:37:13]: Is in light of the fact that she had applied under the special land use permit provisions under your current zoning ordinance, and these are modifications in part to the business licensing and to the zoning ordinance. Technically, what I would say technically. [2:37:13, 2:37:20]: typically would be that those things would not apply to her because she applied before those regulations were put in place, technically. [2:37:22, 2:37:38]: I think that's a question that needs to be answered. Um can you place conditions? The the way around that is to say, okay, if she's not um suscepti if she's not required to comply because she applied before. [2:37:39, 2:37:56]: She would technically be grandfathered in, so to speak. But that does not mean that you cannot place those voluntarily on the applicant. I think she's willing to accept, I think most of them, with the exception of one or two things, because it didn't exist at the time she applied. [2:37:58, 2:38:18]: Come to Mike, if you're gonna talk Brian, couldn't I? I just have a question I would have to present to Valerie since the city is now regulating regulating these things. Will we be opening ourselves up to some liability if we waive some of the requirements, especially those better pertaining to health, safety, and welfare? Well that's what one one second, sir. That's why I asked. [2:38:18, 2:38:38]: Whether or not you mentioned Valerie, but I didn't know whether or not our attorney here would be able to get any type of initial opinion. So what what issues you have a problem with? [2:38:38, 2:38:58]: But come come to if you're gonna speak come to Mike since uh this this one's fine. I'm um it's three people over there. Um we can weigh in on it. It's simply this. She has bested rights for what she's applied to up to this point, right? So she would need a business license and all that stuff this year because if what you just passed would affect business licenses, but since she has her [2:38:57, 2:38:59]: Yeah. [2:38:59, 2:39:07]: Then that would be she would be grandfather into the process up to that point. But if she doesn't get it this go round, then they would apply for her next go round. Are we? [2:39:08, 2:39:28]: She has to apply for a business license. If she gets this approved, she has to apply for a business license to comply with whatever the business license is. For the business license. But I'm saying the fee, the zone. Yeah, that's that's part of the business license. I mean you can get it now, but next year you have to comply with the ordinance. But that would give [2:39:28, 2:39:30]: [9572.1, 9577.7]: Sh because she's applied, she has grandfathered in under what she applied under. [2:39:38, 2:39:41]: Right. So if she goes ahead and completes everything now. [2:39:41, 2:39:45]: then she's fine. When it rolls back around and she has not, then the new [2:39:46, 2:39:50]: ordinances and standards for the business license that you all just passed would kick in. [2:39:51, 2:40:10]: Okay, too many people talking to twelve months. Oh you think twelve month, right? Okay, well that's that's a thought. But you have to keep removing it. If you all pass things that affect your business licenses, anything that would affect it. [2:40:10, 2:40:16]: Everybody's fine until they have to apply for that license again and that's when it comes in unless they have an exemption. [2:40:16, 2:40:22]: Okay. All right. What I'm thinking on this is honestly on a is uh is that [2:40:24, 2:40:44]: What we just passed would have to be adhered to, but we would give you a time limit in order to do it. You wouldn't have to do it immediately, but we would give you twelve months with which to come back and have those requirements met since you and certainly I'm very sympathetic to the things that you have been through and understand. [2:40:44, 2:40:46]: I've done a lot of [2:40:46, 2:41:06]: soul searching and research myself in the past couple of weeks just to understand the need uh that exists and your passion that you mortgage your home and that you've you've you've really went so far beyond what most people would have done because you care makes a difference. It makes a real difference. [2:41:06, 2:41:24]: So I'd be willing to go ahead and do and give you twelve months to, you know, bring on the generator to do the other things that need to be done within twelve months. Hopefully some of the income that would come in would help offset and allow you to get the funds that you need to comply. [2:41:24, 2:41:33]: But that that obviously is uh that's a good idea, but obviously the council needs to agree to that. Plus we need to make sure we got a a good solid legal opinion on this as well before we go forward. [2:41:35, 2:41:35]: Still have it for. [2:41:36, 2:41:39]: I know, I know. I haven't I haven't forgot about a public hearing yet. I know. [2:41:40, 2:41:40]: Okay. [2:41:41, 2:41:43]: Yeah, I I you're right, I haven't. I I know I haven't. [2:41:44, 2:41:47]: Yes. And that's what they're talking about now. [2:41:48, 2:42:08]: I just wanna make sure on the record though, at a minimum she had to be state compliant. At a minimum. I mean, so I just wanna put that in there for the record. I am I am state compliant. I am. Yeah, but I know states sometimes change the laws and rules, and I just wanna make sure in that year time frame that we still stay in compliance with state throughout that process if we grant the business. [2:42:07, 2:42:20]: Right. All right. Every year the year every year the states come, every year they come, you have to renew your license, and if you don't reach the requirement, they cancel your license on you. Every year. [2:42:21, 2:42:22]: Right. [2:42:23, 2:42:32]: All right, since it is a public hearing, so um I'll start on my left side as well. Anybody have any comments for agreement for this to be approved? Any comments for? [2:42:32, 2:42:33]: In the middle. [2:42:34, 2:42:53]: On far right. Any comments against uh this process and um in reference to approval of this personal care on against. On the far left, the middle, far right. Okay, sir. Come on up, name and address please. You have uh negative comments against against this particular ruling. Name and address. [2:42:57, 2:43:17]: My name is Robert Schuhl. I live at 253 Shields Road. That picture up there, my house is directly across the street. At the bottom left corner of that is a two-acre pond. There's no fence in front of that property. We're worried, uh Councilman Alexander, you said somebody wandered off and we found. [2:43:17, 2:43:37]: found them. That's a concern I have. Um there should be a fence in there. And then you guys said something about um spotlights on the property. It's gonna be shining. They've already got one up there that shines in my house and now there's gonna be more shining. I think there needs to be a fence across the front of that. [2:43:37, 2:43:57]: To keep these people from wandering off. That's my concern. And we already have traffic problems with speeding. And if some of these people do get out, these people are going 60, 70 miles an hour down our street. So I think the speed humps would be reasonable. Not saying they're responsible for that. [2:43:57, 2:44:01]: something this the city might consider. Thank you. [2:44:01, 2:44:06]: Thank you for your comments. All right, Council. Uh Ms. Barber, you had some additional comments. [2:44:09, 2:44:17]: after we close public comments. Well pu well, I mean there's no other for or against. I mean we're ready to taper to a motion motion to approve. [2:44:19, 2:44:20]: The public area is closed. [2:44:24, 2:44:30]: This is a district that I represent. This issue has been like a ping pong for nearly a year. [2:44:31, 2:44:38]: Absolutely, I agree with the need of this personal care facility. I've spoken with Miss John. [2:44:38, 2:44:40]: A number of times since last year. [2:44:41, 2:44:47]: So I don't want the record to show that I don't support having personal care homes because I do. [2:44:48, 2:44:58]: City Council District 4 has unique housing needs beyond high density townhome developments and outside of this downtown area. [2:44:58, 2:45:08]: We have unique needs. Most of the areas in my district are legacy residents, and those homes are. [2:45:09, 2:45:15]: Older established homes and established neighborhoods. One of the concerns that I do have. [2:45:15, 2:45:16]: The gentleman. [2:45:16, 2:45:18]: Mr Schulz just mentioned. [2:45:19, 2:45:19]: The lake. [2:45:20, 2:45:22]: That's on his property. [2:45:23, 2:45:24]: That pond [2:45:25, 2:45:26]: Only has fencing. [2:45:27, 2:45:29]: right alongside the roadway. [2:45:31, 2:45:37]: The personal care home only has fencing on three sides. I asked mister Anderson. [2:45:37, 2:45:42]: Will this new text amendment require that the homeowners [2:45:42, 2:45:49]: Um well, for these personal care homes require the entire yard to be fenced. [2:45:50, 2:45:55]: I asked that specifically because I know this particular situation very well. [2:45:58, 2:46:00]: It's a safety concern. [2:46:01, 2:46:08]: And I don't know why that would not be something that staff would take in consideration when they brought this forward for [2:46:08, 2:46:28]: approval without looking at all of the concerns of this particular uh the code has restrictions on fences in the front yard. So about you you you rallied up. The fencing. Yeah fencing in the front yard. There are restrictions on the fences. Entire yard fencing. I asked you about that. The code the code doesn't allow that [2:46:28, 2:46:29]: Okay. [2:46:29, 2:46:38]: The current the current UDC does not allow that, so we'll have to amend the UDC. Does it require entire property be fenced? [2:46:39, 2:46:47]: No, just three quarters. Okay. Well, in this particular instance, there is a pond right across the street. [2:46:48, 2:46:51]: The the the There are no sidewalks, curb and gutters. [2:46:52, 2:46:54]: Nothing. The pun should have a fence around it. [2:46:54, 2:46:55]: Sorry. [2:46:55, 2:46:59]: The the pun should have a fence around it to protect people. The pond does. [2:46:59, 2:47:01]: Only along the roadway. [2:47:02, 2:47:16]: So there's uh what about the furniture of the pun? There's no you should know that. I don't know. I'm saying the pun is required the pun is required to be finished. I do if I can finish my comments here. If I do um [2:47:16, 2:47:22]: If I can. I support this personal care home. What I don't want is to oversaturate. [2:47:22, 2:47:24]: my district [2:47:24, 2:47:26]: With personal care homes again. [2:47:27, 2:47:28]: Again. [2:47:28, 2:47:30]: The northern eastern [2:47:31, 2:47:32]: End of my district. [2:47:33, 2:47:34]: Is all [2:47:35, 2:47:37]: Neighborhood streets. [2:47:37, 2:47:46]: Neighborhood streets in which I have been consistently told, even though there are safety concerns. [2:47:47, 2:47:49]: That roadway Shills Road [2:47:50, 2:47:51]: is a cut through road. [2:47:52, 2:48:01]: And there are a lot of pedestrians who speed up and down that road. I have brought that to the council's attention every single time mister Scholes has been here. [2:48:02, 2:48:05]: He has come to this council at least. [2:48:06, 2:48:16]: I don't know, five times between last year and this ye well, maybe two years ago and this year, he sent a number of emails to this council. [2:48:17, 2:48:21]: They even completed a petition for speed bumps. [2:48:23, 2:48:36]: So for y'all to sit here and now pretend like oh y'all concerned about oh the needs of the community, really? This is my district, but yet you've approved non-high density residential townhomes in my district. [2:48:37, 2:48:38]: My district. [2:48:39, 2:48:41]: I'm not done with my public comments. [2:48:41, 2:48:42]: I will continue. [2:48:43, 2:48:45]: The information that I received was [2:48:46, 2:48:48]: Um last year [2:48:48, 2:48:49]: was inaccurate. [2:48:52, 2:48:56]: I received some new information just last week. [2:49:00, 2:49:10]: Such businesses, such as personal care homes, specifically in City Council District 4, outside of the downtown. [2:49:10, 2:49:13]: are mostly neighborhoods. [2:49:13, 2:49:14]: And what I don't want [2:49:15, 2:49:18]: There's a whole lot of neighborhoods within a [2:49:19, 2:49:22]: One сквер міль від персонал КЕРХОМС. [2:49:23, 2:49:25]: We need diverse housing options. [2:49:26, 2:49:30]: Алсад агає ось остилтон. [2:49:31, 2:49:32]: We need [2:49:33, 2:49:37]: Senior living facilities, we need single family homes. [2:49:40, 2:49:44]: Personal care homes, of course we want them. We want daycares too. [2:49:47, 2:49:58]: I do support this, but we need to figure out what to do with the safety concerns for this particular area. I am concerned about the ponds. [2:49:59, 2:50:00]: I am. [2:50:01, 2:50:06]: I'm concerned about, you know, if the fencing requirement that we have [2:50:07, 2:50:07]: For [2:50:08, 2:50:21]: the personal care home is adequate or if you're going to require now that the homeowner who has the pond on his lot now he has to add more fencing to accommodate this personal care home. [2:50:22, 2:50:28]: There's a safety concern. There's no sidewalks or curb and gutters along that roadway. [2:50:30, 2:50:35]: This has been like a ping pong ball since last year. I want to get it resolved. [2:50:36, 2:50:56]: And Mr. Edmundson, if you can offer some suggestions on how I can go about um ensuring the folks in my district are safe, especially this personal care home. I don't mind approving this with um or grandfathering her in, but we need to address the safety concerns alongside [2:50:56, 2:51:05]: Shields wrote, why do I have to keep constantly having to fight for the needs of my community, the needs of my district? [2:51:05, 2:51:07]: That I've been elected to represent. [2:51:08, 2:51:11]: Why? Why do I have to fight for it every single time? [2:51:13, 2:51:17]: I would like to I asked a question of Mr. Edmondson if you don't mind this battle. [2:51:17, 2:51:30]: I think that you're not traveling with enough information about who's gonna be in the facility before w he can answer that question. So I'd like to respond to that. Okay. Because the people who will be in the facility number one will not have cars. [2:51:30, 2:51:38]: They will not have cars, number two. There may be most of the most of them are there may be visitors, I'm sure. [2:51:38, 2:51:58]: There may be visitors, but what I'm saying is the residents who we are concerned about in terms of their safety, most of them will not I mean not in none of them will have cars, number one, and most of them will be non-ambulatory. In other words, they're in wheelchairs, they will not be out, they will not be walking down the road, they will [2:51:58, 2:52:17]: will not be crossing over to the pond because there will always be a staff person. Um most of them will be, you know, taken out for, you know, day trips and things like that off site. But what they won't be doing is walking up and down the sidewalks or walking down the sidewalk. There are no sidewalks. [2:52:17, 2:52:37]: A again, walking up and down the street or any place else without staff, um, because staff will be probably taking them somewhere off site and not along that um area. So and having a fence along the frontage of the property is not typical, particularly in a residential [2:52:37, 2:52:57]: Context, maybe like a chain link four-foot fence or something like that. But then you would have to have a gate, which means that if the police or somebody, um ambulance or whatever has to come, now they have to tackle and deal with a fence to be able to get up in there. So we would ask not to have that type of a requirement um placed. [2:52:57, 2:53:03]: placed on this particular um uh home. So I'll [2:53:04, 2:53:05]: Defer to you. [2:53:12, 2:53:17]: What what was the question again? I'm sorry. [2:53:18, 2:53:30]: a ping palm since last year. If if the city did not have the appropriate um ordinances in place or the business license structure for [2:53:30, 2:53:32]: Issuing it last year. [2:53:32, 2:53:41]: Why has it taken a year for us to get to this point? So let's stop politicizing every issue, especially when it comes to my district. [2:53:42, 2:53:50]: All I want to know is what is best for me to ensure the safety of the residents in the area. [2:53:50, 2:54:04]: Not just this personal care home, where not this partic not just this particular personal care home, but any other personal care home that may come in my district or any other parts of our city. Right. Please. [2:54:05, 2:54:25]: Um yes man, as we uh said before, uh this one is a little bit different because of course it got grandfathered in, but anyone subsequent from this from tonight will have those restrictions in place. I believe those restrictions in place will ensure the safety of, you know, the housing and the neighborhood that we talked about because there's a whole lot more restrictions on [2:54:25, 2:54:26]: [10466.9, 10486.9]: behind this particular one. Um and like I said before, I think it's not a one size fit all. I believe that staff will be heavily engaged going forward in these type of different areas to seeing these these challenges that may or may not exist. Is there a lot of traffic? Is it you know uh speeding on that roads, all those things would be considered, I believe. [2:54:46, 2:55:06]: When the applicant come before council to apply for that business license, right? Those are some of the things that we can talk about and ask and say, you know, you know, stab, have you done your research on that? Have you noticed any things dealing with traffic or any concerns? Are there any ponds or lakes in the area? And I just believe that that's the time to have that conversation based off [2:55:06, 2:55:11]: off the applicant's, you know, or the location of the applicant after this particular situation. [2:55:13, 2:55:16]: Mayor Ford, I'd like to um make a motion. [2:55:17, 2:55:20]: Alright yeah. Okay. I move to approve. Um [2:55:21, 2:55:33]: Staff's uh recommendation to approve the special use permit to allow personal care home to operate on property at 270 SHIELS Road within an existing single family detached resident. [2:55:34, 2:55:40]: The property is located in land lot seventy of District Twelve and City Council District Four. [2:55:40, 2:55:44]: It will be grandfathered in based on the recommendations of staff. [2:55:45, 2:55:59]: There for clarification, it certainly needs to be a twelve month situation where the compliance is brought into compliance and then twelve months to bring it into the existing compliance. [2:55:59, 2:56:02]: Well that's that's up to whether or not she sept that to be part of her motion. [2:56:04, 2:56:05]: You step to be part of your motion? [2:56:06, 2:56:10]: Yeah, I accept anything anybody else wanna offer. What what else you wanna offer? [2:56:10, 2:56:12]: You got that in the motion? I'm ready to move on. [2:56:13, 2:56:14]: I'm ready to move on. [2:56:15, 2:56:19]: All right. Mr. Alexander second all in favor, please indicate. [2:56:20, 2:56:22]: Now it's decision. Thank you. All right. [2:56:24, 2:56:44]: All right, discuss new business. The Stockbridge Municipal Court is offering an amnesty program for individuals with outstanding traffic violation cases. The program specifically waives um failure to appear FTA arrest warrants for traffic offenses, allowing people to resolve their cases without fear and of arrest. The program will run from September 4th. [2:56:44, 2:56:49]: First to uh September thirtieth, twenty twenty five. Miss Stanley, please. [2:56:50, 2:57:10]: Good evening, Mayor and Council. Evening. My name is Janae Stanley. I'm the court administrator for a municipal court, and I am here tonight recommending that the council adopt an amnesty program to take place September 1st through September 30th and to occur each year thereafter. What is an [2:57:10, 2:57:12]: Amnesty program. [2:57:16, 2:57:36]: An amnesty program is an initiative offering individuals with outstanding fines, warrants, or unresolved cases an opportunity to settle their matters during a specific time period without the uh additional penalties. The goal is to reduce outstanding warrants and license suspensions, clear to court the court. [2:57:36, 2:57:37]: Yeah. [2:57:38, 2:57:41]: And to help individuals avoid further legal complications. [2:57:43, 2:57:49]: The problems addressed with um an amnesty program or um campaign [2:57:49, 2:58:09]: is uh to help individuals resolve their risk of arrest, difficulty obtaining employment, driver's license issues, again the court's mounting backlog and inefficient use of resources, having to house older files, even though we are um 90% paperless, we still uh have to file [2:58:09, 2:58:26]: Well we still hold on to files where that have not been resolved and the community. Um it's uh uh widely known that traffic stops involving a outstanding warrant can be considered more dangerous than a regular traffic or routine stop. [2:58:26, 2:58:32]: And so um this would address that as well and the general lack of trust in the justice system. [2:58:34, 2:58:41]: The benefits again is um to individuals helping to avoid arrest and potential jail time, resolve cases without the penalties. [2:58:41, 2:58:45]: Having a clean record and offering the community a fresh start. [2:58:45, 2:59:05]: Uh, with the court, we will be able to recoup revenues that are owed to us. Again, the efficient use of resources, community improved public safety, and um we could prevent people from committing new offenses. Oh my PowerPoint. Sorry, I'm so sorry. I'm sleepy. [2:59:05, 2:59:11]: Huh, you got it. Thank you. I'm sorry. Um [2:59:12, 2:59:17]: reduced res criminal recidivism, people who are already suspended wouldn't [2:59:18, 2:59:21]: have the temptation of continuing to drive if they [2:59:21, 2:59:33]: Um were made aware again that they have an outstanding offense and we're given the opportunity to address that and then just enhance community trust in the justice justice system, general just goodwill. [2:59:35, 2:59:40]: Okay, and so we are recommending that the program be [2:59:40, 3:00:00]: made available to everyone who has a traffic violation, a city ordinance violation, um misdemeanors, um any sort of citation or case in municipal court that is in FTA status. Of course the school safety zone would not be included. Um we don't really um [3:00:00, 3:00:13]: manage that anyway. We just do the hearings for it. The time frame again September 1st through September 30th. And what's being waived would be the hundred dollar FTA fee. [3:00:15, 3:00:24]: And the hundred and fifty dollar warrant fee waived if the fine is paid in f in full, we wouldn't be lifting warrants for people unless they came into court. [3:00:24, 3:00:44]: Um, they could either walk in or just contact us and schedule a hearing during our business hours. And um if they miss that next court date, we would just reinstate the fee. Individuals would have to pay in full by credit or debit card andor money order, and probation would be uh available to those. [3:00:44, 3:00:48]: that were eligible just like regular probation operates right now. [3:01:01, 3:01:21]: Implementation. Um the court would send out letters to everyone who has an outstanding traffic citation. Uh we would do text message and um work with our PIO to have it announced on our social media outlets as well as the court's website. Um we would also uh arrange additional court cases. [3:01:21, 3:01:32]: calendars if necessary. And I just want to highlight that this is an this initiative is common to municipal courts, courts that have done it recently, Atlanta, Brookhaven, Chambly. [3:01:33, 3:01:40]: You see the list there, Douglasville, Dorville, Duluth, Forest Park, Lovejoy, South Fulton, Stonecrest, Wood, Woodstock are just a few. [3:01:41, 3:01:46]: And from my research, um, courts are able to clear five to twenty five percent. [3:01:46, 3:01:53]: of um old citations. That's closing them and uh getting those funds. [3:01:53, 3:02:01]: And finally, there are no additional costs associated with the program other than the postage we will use to mail the letters. So in summary [3:02:03, 3:02:23]: Uh an amnesty program in in the city of Stockbridge would create a positive impact on individuals, on the court, in our community by giving individuals a fresh start and assisting with clearing cases, and it would just foster a sense of accessibility and equity within the justice system. And that's all I have. [3:02:23, 3:02:25]: Mm-hmm. Questions? [3:02:26, 3:02:33]: I'd like to make a motion to approve the amnesty program proposed as presented by the Ms. Municipal Court. [3:02:34, 3:02:38]: Yes. Okay, m Mr Berry secondary. All favor please indicate. [3:02:39, 3:02:42]: Yeah, it's a season. Congratulations. Thank you. Thank you. [3:02:43, 3:02:50]: All right, uh council consideration to approve selection of an entertainer attorney. I'm assuming uh Sean, you have this? [3:02:58, 3:03:02]: Uh uh Mayor. Yes, ma'am. Is this a personnel matter? [3:03:03, 3:03:23]: It I would say it probably is. Okay. Uh but I like to move this to the personnel to the executive session. I know we have one other thing we have to talk about in the executive session real quick with the development authority, but if it's selecting a entertainment lawyer, then this may need to go under the executive session as well. Or personnel real estate. [3:03:23, 3:03:24]: and liga litigation. [3:03:26, 3:03:28]: It doesn't fall under under those mail. [3:03:29, 3:03:35]: You don't think it falls under personnel? We always talk personnel in executive session. [3:03:35, 3:03:38]: For a contractor? Mm-hmm. Oh, okay. Well [3:03:40, 3:03:40]: For legal. [3:03:41, 3:03:44]: I mean that's just what we normally would do. [3:03:45, 3:03:48]: Okay, so what happened I'm sorry, Mayor Forrest. Go ahead, please. [3:03:48, 3:03:52]: This next item was a council discussion of the city manager spending [3:03:52, 3:03:57]: Which item number are we on? Five six six six no oh okay, sorry. [3:03:58, 3:04:04]: And then we come out and then we vote on who that person is that we select. [3:04:07, 3:04:11]: Ms. Edmondson, you heard that? I I did. Okay. Okay. [3:04:11, 3:04:15]: Council, that's uh make sure that we're rest of the council, you good with that? [3:04:16, 3:04:24]: Yes, yes, yeah. Well we got no yes, yes, sir, we got a discussion. What what were you planning on doing? [3:04:25, 3:04:29]: Uh yes, we had a recommendation. I was trying to find my stuff in my package. [3:04:30, 3:04:31]: Number six. [3:04:41, 3:04:55]: Mayor Ford. Yes, ma'am. Can we um take care of number seven before we go into executive session? Yeah we we plan to to discuss. We we plan to. I had uh it's missing a sheet. Is it [3:04:55, 3:04:57]: Yeah, what I don't see it in here either. [3:05:01, 3:05:03]: I'm gonna leave it at easy. [3:05:04, 3:05:12]: It doesn't uh leave it at P it's No, it was a actual another form that had the three on there. And it's the uh [3:05:14, 3:05:15]: Okay. [3:05:16, 3:05:28]: Okay. So we're gonna discuss this in the second session then. We can.'Cause you don't you don't have anything present to us right now, is that correct? Correct. Okay.'Cause we I had the name and the and the breakdown is just not inside here'cause it wasn't I guess provided enough time. [3:05:30, 3:05:39]: So we'll go to the next session. We have to we'll go to the second session and discuss that then. Okay. All right, sir. And I imagine our legal attorney here. Is that all right with you, sir? [3:05:40, 3:05:51]: Okay. All right. Uh number seven discussion. Council discussion of city manager's spending authority, returning to the spending and contracting author authority up to uh twenty five thousand without city council approval. [3:05:51, 3:05:54]: And Mayor Ford. Yes, ma'am. [3:05:54, 3:05:55]: Okay. [3:05:55, 3:06:02]: This was an item that I requested to add to the agenda um because you were spending an approving contract for the [3:06:03, 3:06:17]: amphitheater and concerts, um, but I don't think it's necessary now that we have a new city manager. I think we need to allow him the opportunity to show us um that he can be fiscally responsible and I believe that he will be. [3:06:19, 3:06:32]: All right, so otherwise to uh remove this from the agenda. Okay, you made a motion to a sec ms again second all in favor indicate? [3:06:33, 3:06:35]: Okay, so now she says, [3:06:36, 3:06:41]: Well, what was what was the motion? The motion to remove this item from the agenda. Okay, thank you. [3:06:43, 3:06:54]: So for m to so for Mr Alzheimer Ms. Gantt all all approved? Okay. Um announcements oncoming meeting events. I'm s I'm sorry, Miss [3:06:56, 3:06:57]: Okay, all right.
