Uh some of these I've covered, applicant disease group properties. [0:37:28, 0:37:30]: They want to rezone from C three to M one. [0:37:31, 0:37:33]: Um seventy nine acres. [0:37:33, 0:37:38]: Um located on south side of st Davidson Parkway and west of Walter Way. [0:37:38, 0:37:42]: Um right now it's vacant land, fairly level and wooded. [0:37:42, 0:37:43]: Yeah, Reese Creek. [0:37:43, 0:37:46]: Uh, traversing the east side of the property. [0:37:46, 0:37:47]: And um [0:37:47, 0:37:50]: All three parcels is on C three. [0:37:50, 0:37:54]: The proposal is to build a business distribution center with five buildings. [0:37:55, 0:37:58]: With a uh close to seven hundred thousand square feet. [0:37:58, 0:38:00]: Of uh office and warehouse uses. [0:38:02, 0:38:06]: We looked at the zoning history of property. There were multiple rezonings happening. [0:38:06, 0:38:10]: This property was actually part of North Bridge Crossing development. [0:38:11, 0:38:11]: Um [0:38:12, 0:38:13]: Some years ago, which um [0:38:14, 0:38:14]: The [0:38:15, 0:38:18]: Adjacent single family residential is a part of that. [0:38:19, 0:38:24]: It had a DRI review that was development regional impact, basically a regional review by [0:38:24, 0:38:29]: regional reviewing agencies. There were some other rezoning cases, development agreement. [0:38:29, 0:38:33]: Uh two years ago there was a Reeves Creek DRI. Um [0:38:33, 0:38:34]: Part of them. [0:38:34, 0:38:36]: The property to the south of this. [0:38:37, 0:38:39]: Uh plus this property was included with [0:38:40, 0:38:43]: Um an a different project that was proposed. [0:38:43, 0:38:46]: And um known as Reeves Creek and [0:38:46, 0:38:48]: It recommended various [0:38:48, 0:38:51]: uh commercial uses on the property. [0:38:51, 0:38:53]: And then now of course we um [0:38:54, 0:38:54]: The [0:38:54, 0:38:58]: This project was large enough because it's over 500,000 square feet. [0:38:59, 0:39:00]: Um it it qualified. [0:39:01, 0:39:06]: for another regional review by Atlanta Regional Commission and Georgia Regional Transportation Authority. [0:39:06, 0:39:08]: I'll I'll discuss that later. [0:39:09, 0:39:13]: The future land use designation of the properties, low density ver vertical mixed use. [0:39:14, 0:39:17]: which does not allow the proposed M1 district. [0:39:17, 0:39:19]: needs to be changed to light industrial. [0:39:19, 0:39:21]: I'll be discussing that later with the [0:39:21, 0:39:25]: Other case, the comprehensive plan amendment CP two oh two one oh one. [0:39:26, 0:39:27]: The [0:39:27, 0:39:31]: project would be accessed by a small parcel off Davidson Parkway. [0:39:32, 0:39:33]: And um [0:39:33, 0:39:35]: Site traffic would come. [0:39:35, 0:39:38]: Off of the interstate семь five and six seventy five. [0:39:39, 0:39:39]: Um [0:39:40, 0:39:44]: And they would use Highway 138 from Clayton County and come to the site. [0:39:45, 0:39:48]: There would be a secondary emergency access onto Walter Way. [0:39:49, 0:39:54]: Uh two community meetings were held by the applicant on August eighteenth and September fifteenth. [0:39:54, 0:39:57]: And we posted signs on the property on September the second. [0:39:59, 0:40:03]: Uh some of this I've covered re already. This just shows a different kinds of [0:40:03, 0:40:04]: research that we did. [0:40:05, 0:40:07]: Here is a aerial photo of the [0:40:07, 0:40:11]: site what you're seeing here is really the large parcel. [0:40:11, 0:40:12]: And then I have [0:40:13, 0:40:13]: Um [0:40:15, 0:40:15]: No, they're [0:40:16, 0:40:17]: Map here. [0:40:17, 0:40:20]: Uh here he these are the interstates here. [0:40:20, 0:40:24]: And the the large parcel goes all the way around here. [0:40:24, 0:40:28]: Linda, I'd like to interject real fast for clarification. [0:40:29, 0:40:49]: Um there were three parcels that were part of this project initially, but after this report went to print, the applicant did note that um there was a smaller parcel, the 1.66 acres parcel, would be removed from this. And for the record, I just want to uh read it into um the minutes as [0:40:49, 0:40:51]: Parcel zero three zero. [0:40:51, 0:40:56]: Dash zero one zero zero nine zero zero six. [0:40:57, 0:41:00]: Um so you can proceed with your presentation. [0:41:00, 0:41:06]: Excuse me, uh actually it's this parcel on Walter Way, this one right here that has the three acres. [0:41:06, 0:41:07]: Because the smallest one this [0:41:08, 0:41:28]: The smallest one is the one that they're going to use for access for the main driveway into the property. Okay, because it was noted in the minutes at the beginning of the report that it was going to be the 1.66. So for clarification, then let me read that out again. The parcel number to be removed from this um property for this rezoning is zero. [0:41:27, 0:41:36]: And this is the property adjacent to Walter Way. [0:41:37, 0:41:38]: Yes. [0:41:39, 0:41:41]: You can move forward, Linda. Thank you. [0:41:41, 0:41:42]: Okay. [0:41:43, 0:41:47]: Uh we looked at surrounding land use and zoning. [0:41:47, 0:41:50]: I'm gonna flip back and forth from this table to [0:41:50, 0:41:52]: This map this is a zoning map. [0:41:52, 0:41:53]: Here's [0:41:53, 0:41:55]: The site here, C three in red. [0:41:56, 0:41:57]: And um [0:41:58, 0:42:01]: And we look surrounding land uses, location number one. [0:42:02, 0:42:03]: Which is up at the top here. [0:42:04, 0:42:08]: This property is very close to the the Clayton County line, which is at the top of the [0:42:09, 0:42:15]: Um of the map. So these are vacant parcels up here. And then number two, this is across the street on [0:42:15, 0:42:18]: Davidson Parkway, those are also vacant, but in the city. [0:42:19, 0:42:19]: Um [0:42:20, 0:42:22]: And three we have [0:42:22, 0:42:25]: We have an automobile refurbishing business. [0:42:25, 0:42:27]: Down here, this large blue square. [0:42:27, 0:42:30]: Uh, in the s to the south east of the site. [0:42:31, 0:42:40]: Um uh number four is uh Hen Henry County to the south. The the southern end of the site is actually the boundary between city and county. [0:42:41, 0:42:42]: And [0:42:42, 0:42:48]: Um North Bridge Crossing, single family residential, of course, is number five. This whole dark green area here. [0:42:49, 0:42:50]: And [0:42:50, 0:42:56]: And finding number six is the in interstates seventy-five and six seventy five. And this is right where the [0:42:57, 0:42:59]: Um if you're going north on [0:42:59, 0:43:07]: I 75 and then suddenly it branches off in a six seventy five and exits. Then that that's right where this is next adjacent to the site. [0:43:09, 0:43:11]: In our research, we looked at um [0:43:12, 0:43:14]: Another plan that was made for this area. [0:43:15, 0:43:20]: This was a LCI study, Livable Centers initiative was done by a consultant a few years ago. [0:43:20, 0:43:25]: It recommended it it identified the area or or recommended the area as being um [0:43:25, 0:43:28]: I seventy five activity center. [0:43:28, 0:43:29]: for major employment. [0:43:29, 0:43:33]: Some of the things in here, a recommended hotel and major commercial uses. [0:43:33, 0:43:34]: And um [0:43:35, 0:43:39]: This right down here is actually the site. I have an enlargement of that. [0:43:39, 0:43:41]: On the next slide here. [0:43:41, 0:43:44]: This is a site you're looking at with the interstates here. [0:43:44, 0:43:45]: So it's [0:43:45, 0:43:48]: Nice and color and then North Bridge Crossing residential in this area. [0:43:49, 0:43:52]: Here is the proposed site plan actually. [0:43:52, 0:43:57]: showing the five buildings in orange that are proposed. This Davidson Parkway. [0:43:57, 0:43:58]: Here to the left. [0:43:58, 0:43:59]: Walter Way. [0:44:00, 0:44:10]: is here and the residential uses are here. Free for orientation, the post office is just off to the left. Interstate's at the bottom. [0:44:10, 0:44:10]: і [0:44:11, 0:44:13]: Site would have only one. [0:44:13, 0:44:18]: Main driveway right here off Davidson Parkway and that would be through that small parcel. [0:44:19, 0:44:21]: There would be a secondary [0:44:21, 0:44:25]: Access here, but only for emergency vehicle vehicles. [0:44:25, 0:44:27]: We've had our um [0:44:27, 0:44:33]: uh fire marshal to look at this and um he has approved it the width the low and the location and everything. [0:44:33, 0:44:37]: And he's also looked at the driveway access and [0:44:37, 0:44:41]: Verified that it would be good as far as turning movements for [0:44:41, 0:44:43]: emergency ve vehicles. [0:44:43, 0:44:45]: Uh throughout the property. [0:44:45, 0:44:50]: Uh, there would be uh office uses primarily in the fronts of the building. [0:44:50, 0:44:52]: And uh warehouses to the rear. [0:44:53, 0:44:56]: And a lot of parking proposed, both employee parking. [0:44:57, 0:44:58]: And uh [0:44:58, 0:45:01]: What they call in trailer spaces, these would be for the large trucks. [0:45:02, 0:45:02]: Maybe about [0:45:03, 0:45:04]: Fifty three feet long. [0:45:04, 0:45:05]: Um provided. [0:45:06, 0:45:08]: Um adjacent some of these buildings. [0:45:09, 0:45:16]: Let's see. Oh, and there was a Reefs Creek is up uh uh here in the dark green Jason to the site. There would be [0:45:16, 0:45:17]: Plenty of buffering. [0:45:18, 0:45:19]: uh required um [0:45:19, 0:45:21]: Between the the [0:45:21, 0:45:24]: Development and the houses here. [0:45:24, 0:45:25]: Existing house. [0:45:26, 0:45:28]: Project impacts. Now they [0:45:28, 0:45:33]: The applicant did submit a had a traffic impact study done and it showed that [0:45:33, 0:45:37]: Uh nearby intersections would operate at levels E and F, which are [0:45:38, 0:45:38]: Um [0:45:38, 0:45:40]: Not good, they're forced flow. [0:45:40, 0:45:43]: Uh yet no traffic improvements were recommended. [0:45:43, 0:45:46]: Um they did did uh say that um [0:45:47, 0:45:51]: Um, you know, traffic would be utilizing the different highway one thirty-eight and [0:45:52, 0:45:53]: Maybe some maybe [0:45:54, 0:45:58]: Oh highway one hundred thirty eight maybe should be uh widened and that's something to be looked at. [0:45:58, 0:46:01]: And so forth and maybe some traffic signal improvements. [0:46:01, 0:46:04]: Um in the DRI review we had Greta. [0:46:05, 0:46:06]: Um [0:46:06, 0:46:09]: conduct the review and they said this project [0:46:09, 0:46:12]: Is in the best interest of the state. This means that [0:46:13, 0:46:16]: Uh st spending of state and federal funds would be authorized. [0:46:17, 0:46:20]: provided that no material changes are made to the site plan. [0:46:20, 0:46:22]: And these are the conditions here. [0:46:22, 0:46:24]: Провайд сава сайдвакс алонг. [0:46:25, 0:46:27]: Developments frontage on Davidson Parkway. [0:46:27, 0:46:30]: Install a crosswalk at the main driveway entrance. [0:46:31, 0:46:32]: Install pedestrian [0:46:32, 0:46:33]: Infrastructure [0:46:33, 0:46:36]: Within the site, basically along the driveway inside of the site. [0:46:37, 0:46:40]: And install signage to restrict trucks. [0:46:40, 0:46:44]: On Davidson Parkway between Walter Way and North Henry Blue Arnolds. [0:46:44, 0:46:45]: We don't want them going. [0:46:46, 0:46:46]: Going [0:46:47, 0:46:48]: Turning east to go to [0:46:49, 0:46:52]: North Henry Boulevard that way, the city, uh [0:46:52, 0:46:53]: Uh [0:46:53, 0:46:56]: wants that, wants to restrict trucks in that area. [0:46:56, 0:46:59]: Uh Atlanta Regional Commission also reviewed this. Um [0:47:00, 0:47:04]: The proposal and said it would be compatible with several regional plans policies. [0:47:07, 0:47:12]: Uh we it we looked at different uh let's see, did I cover everything? [0:47:12, 0:47:13]: Yeah. [0:47:14, 0:47:14]: Okay. [0:47:15, 0:47:21]: Uh, I'm not gonna read all this, just gonna touch on a few things. These are different criteria that are listed in our staff report. [0:47:21, 0:47:22]: Um [0:47:22, 0:47:25]: That we're required to look at consistency with [0:47:25, 0:47:28]: comprehensive plan, it would not be as I mentioned. [0:47:28, 0:47:29]: Um [0:47:29, 0:47:30]: Uh [0:47:30, 0:47:34]: Whether the rezoning amendment is um you know compatible with the [0:47:34, 0:47:36]: The uh intent of uh the zoning code. [0:47:37, 0:47:39]: Listed a few things here would not promote [0:47:39, 0:47:43]: prosperity and general welfare of the j with the adjacent residential neighborhood. [0:47:44, 0:47:46]: Would add to traffic congestion. [0:47:46, 0:47:51]: Uh, it would have a lot of tractor trailer trucks, could present safety hazards to pedestrians. [0:47:52, 0:47:57]: Um it would cause significant concentration of population overcrowding on the property. [0:47:57, 0:48:00]: There'd be a huge influx of additional traffic in the neighborhood. [0:48:01, 0:48:05]: Now we're saying that the property is landlocked because there is no other access. [0:48:05, 0:48:09]: Uh to the south, no road going to the south, and then the interstates. [0:48:09, 0:48:12]: to the west. So trucks would be required. [0:48:12, 0:48:15]: to use Davidson Parkway and no nowhere else that they could go. [0:48:16, 0:48:16]: Um [0:48:17, 0:48:21]: In general, it's not desirable to have industrial uses next to residential uses. [0:48:21, 0:48:22]: And um [0:48:23, 0:48:27]: And the property could be developed as it's currently zoned with commercial uses. [0:48:27, 0:48:31]: As three studies recommended, these previous ones that that we studied. [0:48:32, 0:48:34]: All recommended different your hotels. [0:48:34, 0:48:35]: And um [0:48:35, 0:48:40]: um other uh retail, maybe convention center, things of that nature. [0:48:40, 0:48:41]: Um [0:48:42, 0:48:46]: So we don't we don't think um this would be uh good for good for the city. [0:48:47, 0:48:48]: Move to the next slide. [0:48:50, 0:48:53]: Okay, uh site is physically [0:48:53, 0:48:55]: Capable, we think um [0:48:55, 0:48:57]: Handling the development. [0:48:57, 0:48:58]: Um [0:48:59, 0:49:04]: You don't think again, don't think the trucks will be compatible adjacent uh land use uh residential. [0:49:05, 0:49:05]: Um [0:49:07, 0:49:08]: Now the [0:49:10, 0:49:11]: Although try uh [0:49:12, 0:49:13]: So we think that this [0:49:13, 0:49:16]: Again, the property could be developed is better used. [0:49:16, 0:49:18]: Under C three for commercial uses. [0:49:18, 0:49:22]: Uh, particularly because there'd be no truck track to trail or trucks. [0:49:22, 0:49:27]: There might be more traffic, but that would be better than having lots of trucks going through the neighborhood, we think. [0:49:28, 0:49:32]: Uh, if com major commercial uses were developed, those could possibly provide. [0:49:32, 0:49:34]: services to the general public. [0:49:34, 0:49:37]: Whereas the proposed industrial development [0:49:37, 0:49:41]: would mainly serve the internal needs of the businesses who would locate there. [0:49:42, 0:49:44]: And also, this is one of the few large [0:49:45, 0:49:47]: Undeveloped tracts of land left in the city. [0:49:48, 0:49:50]: scarcity of of s such tracts. [0:49:50, 0:49:52]: And it may be a unique opportunity. [0:49:52, 0:49:56]: to develop it into something special with the commercial uses for the public. [0:49:57, 0:49:59]: So therefore we in view of all these [0:49:59, 0:50:01]: Uh things we looked at would recommend denial. [0:50:02, 0:50:03]: Of this proposed rezoning. [0:50:04, 0:50:05]: From C three to M one. [0:50:06, 0:50:11]: Uh however, if the council decides to approve this, we've identified some zoning conditions. [0:50:11, 0:50:13]: These are all in a staff report. [0:50:13, 0:50:14]: Um [0:50:15, 0:50:18]: Again, the future land use designation would need to be changed. [0:50:18, 0:50:21]: Uh, the applicant does need to have um [0:50:21, 0:50:23]: Because they're now two parcels. [0:50:23, 0:50:27]: Would need to be combined into one parcel, and that would be a separate process. [0:50:27, 0:50:30]: City those allowed them to wait on that to see if [0:50:31, 0:50:34]: rezoning is approved and then would do the recombination later. [0:50:36, 0:50:36]: Um [0:50:36, 0:50:42]: transportation improvements would have to comply with what what the DRI uh recommendations were. [0:50:42, 0:50:44]: Or or conditions where rather [0:50:45, 0:50:47]: And then there's always a usual um [0:50:47, 0:50:48]: procedural manners of [0:50:49, 0:50:52]: zoning code specifies they've got eighteen months to [0:50:52, 0:50:54]: Have a major construction. [0:50:54, 0:50:57]: uh to keep the zoning so forth. [0:50:57, 0:51:01]: So again, our recommend is d m recommendation is denial. [0:51:01, 0:51:02]: Are there any questions? [0:51:05, 0:51:10]: Yes. Uh Linda, would you mind putting back up the site map, please? [0:51:10, 0:51:11]: Okay. [0:51:16, 0:51:17]: Here we are. [0:51:19, 0:51:20]: Okay. [0:51:22, 0:51:28]: Unless I'm interpreting this co uh incorrectly, and and please correct me if I am. [0:51:30, 0:51:31]: It appears to me. [0:51:32, 0:51:41]: That these buildings, these proposed buildings, would be fronting or facing the freeway. [0:51:42, 0:51:46]: And most of the warehousing activity. [0:51:47, 0:51:48]: With the trots, et cetera. [0:51:50, 0:51:55]: are gonna be on the opposite side, which will back up to [0:51:55, 0:51:56]: The residential. [0:51:57, 0:51:58]: Element [0:51:59, 0:52:01]: Oh plus [0:52:01, 0:52:04]: Uh a necessitated buff without you speak up. [0:52:05, 0:52:07]: Am I correct in in my interpretation? [0:52:08, 0:52:13]: Well, the office uses are supposed to be at at the front primarily. And then what you said at the beginning. [0:52:14, 0:52:22]: The trucking and warehousing would be to the rear, yes, adjacent to the the buildings from what I'm interpreting. [0:52:23, 0:52:25]: The rear of the buildings are [0:52:26, 0:52:31]: pointing toward the residential. The front of the buildings are facing the freeway. [0:52:32, 0:52:52]: Am I am I interpreting that incorrectly or I it's it's John Coleman Lynn? I'm I don't need to interrupt and tell me to stop if I need to, but that's correct for buildings 400 and 500. Uh building 200, the office area will be facing uh both towards the residential area and then the other building 100 will be facing towards the [0:52:52, 0:53:12]: Interstate and building 200 would be screened on the service areas. Where we do have 400 and 500, we've got the increased setbacks. The minimum is 100 feet, but for 500, it approaches 500 to 600 feet. And that green, dark green area will re remain undisturbed trees. [0:53:12, 0:53:13]: That are existing. [0:53:13, 0:53:15]: Sorry, then the helps clarify. [0:53:16, 0:53:25]: So uh if not all, then a large percentage of this development would be facing the freeway, but the warehousing activity [0:53:27, 0:53:28]: Faith in the residential. [0:53:30, 0:53:31]: Correct for two of the five buildings. [0:53:33, 0:53:33]: Okay. [0:53:34, 0:53:41]: Just wanted to point that out because I I I think the way it was presented was a little misleading. And I just wanted to bring some clarity to that. [0:53:42, 0:53:42]: Thank you. [0:53:43, 0:53:45]: Uh Mr. President, may I speak? [0:53:46, 0:53:47]: Yeah, well go ahead, Mr. Tivodle. [0:53:49, 0:53:53]: uh this is this is a s suggested uh we have a neighborhood [0:53:54, 0:53:55]: That [0:53:55, 0:54:01]: They're having commercial property. I mean commercial vehicles run through them from this other uh commercial. [0:54:02, 0:54:04]: Property that's already there. [0:54:05, 0:54:06]: Uh [0:54:07, 0:54:09]: Is it any way that we can have a uh [0:54:10, 0:54:14]: be able to stop the commercial property from going through the neighborhood. [0:54:15, 0:54:17]: And maybe come through this project. [0:54:17, 0:54:18]: That we're trying to uh [0:54:20, 0:54:21]: Look at right now. [0:54:22, 0:54:24]: Uh I just a question I'm putting out there. [0:54:24, 0:54:28]: Because I know the area and uh most people don't talk about it. [0:54:29, 0:54:30]: But they have [0:54:30, 0:54:33]: uh commercial vehicles going through a a a neighborhood. [0:54:37, 0:54:38]: Anybody aware of that? [0:54:38, 0:54:54]: I am aware of that, uh uh Mr. Thibodeau, and I concur with you if it's engineering possible and if it's can be coordinated with the the owners of the adjacent property. [0:54:54, 0:55:06]: It looks like to me on the plan that this road that's coming through is has a future designed to run into the property at in Henry County. [0:55:07, 0:55:10]: Неу і семс то мі. [0:55:10, 0:55:17]: If it's doable, I don't know if it is. I'm not an engineer, but I concur if we could make an access. [0:55:18, 0:55:22]: from the drive time property into this development. [0:55:22, 0:55:36]: connect the road there and shut off the entrance that's in the c in the subdivision. I don't know if that's engineering possible or illegally possible and Ms. Johnson could address that, but [0:55:36, 0:55:38]: I would be [0:55:40, 0:55:41]: Cattle. [0:55:42, 0:55:50]: Wanted to see that happen before I could get wholeheartedly on board with supporting this. Uh, and I do, I am aware that the the uh [0:55:51, 0:55:57]: Drive time was there before the subdivision was built. And I can't speak to how they allowed that to happen, you know. [0:55:57, 0:56:00]: Three, I believe, when the subdivision came online. [0:56:00, 0:56:01]: But [0:56:02, 0:56:05]: I I agree if you could direct the redirect that. [0:56:06, 0:56:09]: traffic from drive time through this development. [0:56:10, 0:56:12]: It might be a little easier to digest. [0:56:13, 0:56:18]: Uh I agree with you and and also I I know that they've done a traffic study. [0:56:18, 0:56:21]: But I hadn't heard anything from the citizen itself. [0:56:22, 0:56:27]: Have there been any interaction with the citizens as far as that area is concerned? [0:56:28, 0:56:39]: And I think the issue about trying to reroute the commercial property, I mean commercial vehicles away from their subdivision would be a a a great idea to consider. [0:56:39, 0:56:44]: I'm just putting it out there uh for a study what the city might want to consider that. [0:56:44, 0:56:48]: Or the the owners of of both properties might want to look at that. [0:56:49, 0:56:50]: As an option. [0:56:50, 0:56:53]: to relieving a neighborhood of its uh [0:56:54, 0:56:56]: commercial vehicles coming through their neighborhood. [0:56:56, 0:56:58]: This is suggest and only. [0:57:00, 0:57:06]: Mr. Mr. Thibodeau, Mr. Mr. Dumas, if I can before the the applicant jumps in. [0:57:07, 0:57:14]: I I do understand the the intent. I don't know that it it should be part of this particular um [0:57:15, 0:57:19]: uh rezoning because that would that would be a conversation between [0:57:19, 0:57:24]: the drive time owners and this property owner for this rezoning. [0:57:24, 0:57:29]: Um I know I think one of the some maybe some of the challenges might be is that that buffer. [0:57:29, 0:57:35]: kind of spans the full, you know, um north side or or on the side to the east side. [0:57:35, 0:57:45]: of the property um that may pose some challenges, uh, but I guess we'll, you know, talk with the applicant to see if it's something they're willing to look into. [0:57:45, 0:57:46]: as a contingency of uh [0:57:47, 0:57:49]: uh recommendation of approval from from this board. [0:57:50, 0:57:53]: Well here's the thing, uh even as a boy. [0:57:54, 0:58:00]: It is above it's it is our responsibility to look at options that may be available. [0:58:00, 0:58:06]: to create some form of relief that we may recognize when it comes to commercial development versus [0:58:07, 0:58:07]: A community. [0:58:08, 0:58:12]: And it would be wrong of me not to put that out there. [0:58:12, 0:58:16]: And knowing that knowing the area and what's really going on. [0:58:16, 0:58:19]: We should also talk about issues. [0:58:20, 0:58:21]: that impact [0:58:21, 0:58:23]: The community as a whole. [0:58:24, 0:58:26]: And and I understand the commercial [0:58:26, 0:58:30]: properties and what they're trying to do. But if there's an opportunity. [0:58:31, 0:58:32]: To create some relief. [0:58:33, 0:58:38]: For a subdivision in any form or fashion, I I think that should be put out there. [0:58:38, 0:58:40]: To a certain degree. [0:58:40, 0:58:44]: One thing I may not have mentioned is that there was supposed to be a stub. [0:58:45, 0:58:47]: A a road stub. [0:58:47, 0:58:50]: included at the south end of this site which could [0:58:51, 0:58:54]: then be extended in a future to the south. [0:58:55, 0:59:02]: into Henry County and maybe if that extension is done, then there could be a a connection to the east to the drivetown property. [0:59:03, 0:59:05]: That wouldn't work because [0:59:07, 0:59:11]: If you extend the road to the south, you're bypassing the drivetime property. [0:59:13, 0:59:16]: The road needs to some at some point turn east. [0:59:17, 0:59:22]: If you're going to create the kind of relief that that Mr. Tibdo is talking about, at some point. [0:59:24, 0:59:26]: near building five hundred. [0:59:27, 0:59:28]: That parking lot [0:59:28, 0:59:33]: That bit that that road would have to turn and go east to connect with the drivetown property. [0:59:34, 0:59:36]: Taking it further south doesn't do any good. [0:59:44, 0:59:50]: Well my applicants to this I'm sorry, I'm sorry, let me let me let me ask a full question. [0:59:50, 0:59:59]: What has the um subdivision said about this project? Because I went over there and I looked at it. My major concern was that it was really I felt like it was really impacting. [1:00:00, 1:00:01]: Uh the subdivision. [1:00:01, 1:00:06]: And there's no way to control or confirm that this traffic would not pass through that subdivision. [1:00:06, 1:00:10]: I mean, it could be backed up on thirty and they're looking for an alternative. [1:00:10, 1:00:16]: They would definitely go through that neighborhood and that would have a tremendous impact on the infrastructure and the neighborhood itself. [1:00:20, 1:00:28]: Uh that's correct, Chairman. There were two uh public meetings that community meetings that the applicant setup [1:00:31, 1:00:33]: What was the response from the community? [1:00:34, 1:00:35]: Yeah, it's um called. [1:00:35, 1:00:45]: um having was actually was partially, you know, they they had those same concerns about traffic, same concerns about um, you know, the the impact of trucks on the road. [1:00:46, 1:00:48]: you know, in addition to the trucks that are on the road now. [1:00:49, 1:00:57]: That was the the primary concern. And the applicant can can speak to that as far as some other challenges or things that he was hearing from the public. [1:00:57, 1:01:06]: So, you know, those meetings did take place, but you know, those concerns were similar across the board from the residential community. [1:01:07, 1:01:17]: Madam Director, may I ask a question? Would there be an opportunity tonight for any public comment on these two cases? [1:01:18, 1:01:27]: Absolutely. We're actually required by Roberts Rules of Order and the zoning ordinance to allow for folks who want to speak in um [1:01:27, 1:01:31]: favor of the request ten minutes total. [1:01:31, 1:01:41]: And then 10 minutes total uh for those who want to speak um against. That's what I thought, but I didn't see a public comment item on the agenda, so that's why I raised the question. [1:01:42, 1:01:51]: Yes, sir. This is this is considered a public hearing. You're you're absolutely correct. Thank you. Will that happen at the between uh at the HK? Yes. [1:01:52, 1:01:57]: Typically, um, because there's discussion now, um, the applicant has the opportunity to add [1:01:57, 1:02:03]: Tim to talk for 10 minutes as well to you know make sure that you all answer any questions. [1:02:03, 1:02:10]: uh make any statements um before we go into the public hearing process. Thank you. [1:02:10, 1:02:11]: Absolutely. [1:02:12, 1:02:14]: Any other questions on this matter? [1:02:17, 1:02:25]: Then uh can we hear from the applicant? Uh he's heard uh our comments and uh our interests and concerns, and maybe he can address those. [1:02:27, 1:02:36]: Thank you. Um, my name is John Coleman with East Group Properties. We're the applicant. Michelle Battle is also, uh, I think on the line. Michelle, are you available to to to [1:02:37, 1:02:39]: To start the discussion, or you want me to jump in? [1:02:43, 1:03:03]: Okay, she may have a conflict. So let me jump in. Uh, thank you for your time tonight. Um, appreciate the opportunity. Also, want to thank the Stockbridge staff for their efforts during the entire process. Give you a little bit of a uh background on who we are, East Group Properties. We've been in business for 50 years. Our properties are located in the Sunbelt states from Atlanta to Southern California. [1:03:03, 1:03:23]: California or publicly traded on the New York Stock Exchange. What really sets us apart is we're a long-term owner. We don't sell the properties we develop. So we're not going to come in here, build some buildings, lease them up, and then look for a quick sale. Because of that, we we put more detail into the buildings, the landscaping, the signage, and we really are more of a developer. [1:03:23, 1:03:25]: Grow a quality business park. [1:03:25, 1:03:45]: Let me tell you what we're not. We're not uh we don't build large industrial facilities. We're not drive time. We are what we call business distribution. Our buildings are smaller, as you can see from the site plan, and we cater the local businesses in the local area. We will build these as specs. We really can't tell you right now what companies will move into those. [1:03:45, 1:04:05]: Buildings, but with 50 million square feet in our portfolio, we will pull from those uh different companies and really try to locate quality companies in these buildings. Um, average tenants range from 30 to 50,000 square feet. So again, we're not doing these big mega facilities. Uh each space typically has uh [1:04:05, 1:04:12]: office and showrooms, that office and showroom component will range from 10% of the overall space to 80%. [1:04:12, 1:04:32]: Uh each building will have uh two to three uh different uh companies, most likely. Uh because of the higher office space, we talked a lot about traffic already. We have more cars that come into our facilities than trucks. Actually, the traffic report that was completed for the DRI showed that there are twice as many cars that enter and exit our properties. [1:04:32, 1:04:48]: for the office area uh than for every one truck. So this is not a truck terminal. These are businesses that have more cars than trucks. The trucks can be FedEx or UPS delivery, box type trucks, and there will be larger trucks also. [1:04:49, 1:04:54]: Give you some examples of some of the tenants we're currently seeing. And that demand has shifted a little bit. [1:04:55, 1:05:15]: Right now we're we're we're seeing a lot of demand from biomed and pharmaceutical fulfillment companies. Um other properties we own have Aetna, Blue Cross, Blue Shield, Davida, and those attract very high-paying jobs and have much more office associated with them. We're also seeing increase in retail and e-commerce fulfillment. [1:05:15, 1:05:20]: Fulfillment. They have curbside pickup. Examples in our portfolio include Best Buy. [1:05:21, 1:05:24]: Peloton Wayfair Nike. [1:05:24, 1:05:44]: And then on the entertainment sign, we're seeing more demand for movie studios, uh, a big demand for that in Atlanta. These are perfect spaces with high clear height to create those studios internal. Um, in Florida, in Orlando, we have Universal Studios uh in one of our buildings, and then in Tampa, Norwegian cruise lines, same type of entertainment type. [1:05:44, 1:05:45]: type uses. [1:05:46, 1:06:02]: Um, and then for clarification on the staff report, our businesses mainly have normal business hours of operation, uh, usually working um you know from those normal hours. Yeah, again, they're specs, so I can't say for sure, but there's not a lot of around the clock type of uses that we have. [1:06:03, 1:06:23]: And I really want to focus on the local job creation for the residents of Stockbridge. We identified about two to three thousand new jobs that would be created. That would include new construction, that would be about 30 to 40 percent of that. And we'd like to partner with the city and the staff, local EDC, to really push the city employment with the [1:06:22, 1:06:42]: These new customers. Um, real quick on this um on the site plan, you'll notice all the green area. This site has 52% of it is green, uh open space, landscaped, and buffer. Uh, the trees in the dark green area will not be removed along the stream. So all that buffer that exists between the homes and these homes and these buildings will be. [1:06:42, 1:06:54]: um will be used as a screening buffer and if and if there's gaps in that we will landscape additional trees in there to block those gaps. That'll provide visual and also audio insulation. [1:06:54, 1:07:01]: Uh the access row we talked about will be extended south. I'll talk about the uh the the connection to drivetime here in a second. [1:07:01, 1:07:08]: And then the nature trail in black will run along the stream. We will also donate a one acre park to the city. [1:07:09, 1:07:29]: Did want to touch on the um the current zoning. Um, the traffic that would be generated by the current zoning and the traffic plan that's been uh or the site plan that we saw at the beginning of the presentation, it'll have six times the number of vehicles that our project is uh anticipated to generate, six times. Right. [1:07:29, 1:07:49]: Right now, on a daily uh trip basis, we will generate 1,144 vehicles compared to 7,500 vehicles. I know that's commercial, but it's a heavy commercial use. Um, and we are one of the lowest traffic generators compared to apartments, office, retail, gas stations, all those uses. [1:07:49, 1:07:50]: allowed in the current zoning. [1:07:51, 1:08:06]: Um traffic leaving our project will mainly turn left on Davidson to get to I-75 and 675. That's that's why we like the site so much. As you look at the access back to the interstate, most of these vehicles will all be leaving, going back to the interstate and not through the community. [1:08:07, 1:08:27]: Um, we are not drive time. And if successful, uh I will uh I will approach them about uh a possible sale of that site. We understand the the concern there. Um we would look at buying that facility and then redeveloping it and then looking at the the traffic, which will most likely go south to the future um south. [1:08:27, 1:08:30]: into Henry County for the future access to the south. [1:08:30, 1:08:30]: Um [1:08:32, 1:08:50]: Also want to clarify we do not have any buildings fronting Walter Way, only the magic, the um the access uh for emergency vehicles. Uh land acquisition, we've been working on the site for 18 months. Uh we've included uh the DRI and the Greta approval for the site, including the traffic generation. [1:08:50, 1:09:03]: Uh the current zoning is of C3 is heavy commercial. A lot of that traffic will be generated outside the normal business hours that would be in the nighttime and further impacting the residents. [1:09:03, 1:09:04]: Um [1:09:05, 1:09:25]: One thing I really wanted to touch on the previous uh DRIs for Reeves Creek and Northbridge, they were both commercial DRIs and for commercial use. I'm sure they aggressively marketed those sites to try to put those developments into production, but neither one was able to really attract those uses because of there's just really no demand. [1:09:25, 1:09:32]: demand for that right now. And then in the current business cycle, it's actually shifted even more. People are working from home. [1:09:32, 1:09:52]: They're not going to offices with e-commerce shopping online instead of going to retail stores for this economy. It's now even less likely to support new office and commercial uses than it was when those other two DRIs failed to produce. Um, it didn't work in the past, and I think it's more, it's just unlikely it will work now. And for what it's worth, [1:09:52, 1:09:53]: Yes. Um [1:09:53, 1:10:13]: You know, other cities have embraced our product type, um uh our developments, our our long-term ownership, and it's been a great partnership. Um, you know, we've we've been embraced and they actually have have come to us to see if we could locate in those cities. Um we're long-term owner and and they like the the focus on on greater job creation. [1:10:13, 1:10:18]: which will help serve the overall residential community in Stockbridge. [1:10:20, 1:10:21]: Oh yeah, yeah. [1:10:21, 1:10:25]: I'm sorry, go ahead. No, I thought no, I thought you were finished. Go ahead. [1:10:25, 1:10:30]: I was just gonna ask if Michelle was on the line, if she had any more to to to address, but I I'm not sure she's here. [1:10:31, 1:10:36]: You know that that that that option for drive time, my primary uh concern is a traffic through the community. [1:10:37, 1:10:38]: And wow. [1:10:38, 1:10:42]: We can say that uh trucks won't transfer uh traverse that area. [1:10:43, 1:10:46]: In reality, if they have an opportunity or some convenience for them, they would. [1:10:47, 1:10:50]: Uh so uh if if if you could [1:10:51, 1:10:52]: Connect with drivet. [1:10:53, 1:10:55]: uh to ensure that that wouldn't occur. [1:10:56, 1:10:58]: You know, w that would be less likely to occur. [1:10:59, 1:11:00]: Oh [1:11:01, 1:11:02]: deal would probably fly. [1:11:03, 1:11:03]: You know. [1:11:03, 1:11:05]: But uh as it stands right now. [1:11:06, 1:11:07]: Uh [1:11:07, 1:11:13]: focuses on the community, the residents, then impact that the uh trucks would have on the infrastructure in the community. [1:11:14, 1:11:21]: So I I mean I don't really know how you address it other than to acquire that and make a direct access to the uh expressway. [1:11:22, 1:11:22]: Uh [1:11:23, 1:11:24]: That would be it. [1:11:25, 1:11:29]: Uh the uh job component of it is is most certainly attractive to uh [1:11:30, 1:11:32]: Ви атлектати Хенри тут. [1:11:33, 1:11:34]: Uh [1:11:34, 1:11:36]: Called employment is always uh [1:11:38, 1:11:41]: uh favorable aspect of any development. [1:11:41, 1:11:45]: But you also have a community there that we had to be concerned about. [1:11:47, 1:11:50]: And I think Mr. Thibodeau and Mr. U [1:11:50, 1:11:52]: Doom is articulated that well. [1:11:55, 1:12:15]: Yes, I I didn't mention we did look at the challenge with the direct connection is one, we were more focused on the impact of our development on the community and the adjacent roads, not so much uh drive times, and that was a pre-existing condition. We did look at the the transition um and the the topo, you see the creek, uh that's a protection. [1:12:14, 1:12:31]: protected area and the the stream crossing in the topo makes that connection almost impossible uh in a three-dimensional perspective. We did look at it. Those are protected areas. A stream cannot be impacted more than a certain area without having major impact. [1:12:32, 1:12:41]: Uh yeah, what w what we what we expect would happen with that connection to the south is that Henry County appears to have some transportation um [1:12:42, 1:12:47]: um plans to go further south to an east-west connector. Wesley, I I don't remember that name. [1:12:47, 1:12:56]: But what we expect is if there's a connection to that, to our driveway, then that would be a connection that drivetime could could connect to in the future. [1:12:58, 1:13:00]: Mr. Coleman, um [1:13:01, 1:13:08]: You have this property under contract with GDC or GD, I may not be saying that right, the current owner. [1:13:08, 1:13:12]: Yes, sir. And that contract is contingent on this being approved? [1:13:13, 1:13:14]: Yes, sir. [1:13:15, 1:13:16]: Thank you. [1:13:18, 1:13:38]: John, I just wanted to, there's one thing I wanted to add. Um, in the in the staff report, it did mention the the level of service E and F on the intersections in the area. Those are existing conditions. We're they they are level of service ENF currently, and our traffic study shows that we're not making that condition. [1:13:37, 1:13:47]: condition worse. And that was when when Greta, the regional authority, looks at at a you know an a traffic issue. [1:13:47, 1:14:02]: it it's not created by our development. And so they can't say you have to widen 75. That's not a that's not a reasonable uh consideration for you know for a developer to undertake. [1:14:02, 1:14:09]: Um so that that was looked at. Um also the infrastructure uh part of the uh [1:14:09, 1:14:18]: In the beginning of this year, the DRI process was was slightly tweaked to include analysis of the [1:14:19, 1:14:34]: uh the pavement between the development and uh you know the the interstate and the the the turning movements between the development and the interstate and so those were those are things that were considered and reviewed during the DRI so I just wanted to note that um [1:14:40, 1:14:41]: Mr. President, may I speak? [1:14:42, 1:14:43]: So [1:14:44, 1:14:45]: Uh as a [1:14:45, 1:14:49]: Planning zoning board, we we have a responsibility. [1:14:50, 1:14:56]: to look at look at things that may have issues or problems concerning zoning. [1:14:57, 1:15:02]: And the only one that I'm looking at still is it's looking at some form of [1:15:02, 1:15:03]: Relief. [1:15:04, 1:15:05]: Was subdivision. [1:15:06, 1:15:07]: If there's a possibility [1:15:08, 1:15:08]: Oh. [1:15:08, 1:15:10]: taking in the commercial traffic. [1:15:10, 1:15:13]: from out of the middle their their subdivision. [1:15:14, 1:15:14]: And uh [1:15:15, 1:15:19]: If there's any way possible to do that, I I think we should at least [1:15:20, 1:15:21]: Uh [1:15:21, 1:15:23]: put something in effect to look at that. [1:15:24, 1:15:25]: What is [1:15:25, 1:15:26]: Now or later. [1:15:27, 1:15:31]: to to possibly have something done because I think it's unfair for us [1:15:32, 1:15:33]: So just not. [1:15:34, 1:15:36]: Avoid it, just avoid it and not really. [1:15:37, 1:15:39]: Considered fact that we have an opportunity. [1:15:41, 1:15:42]: to change something around that. [1:15:43, 1:15:45]: shouldn't have been done for the first place. [1:15:53, 1:15:55]: Permission to speak, Mr. Chair. [1:15:55, 1:15:56]: No. [1:15:56, 1:16:11]: Uh I I was curious. I know we're not sure of what businesses will come into the area. Are there any restrictions on businesses? I know there's a daycare near there, um, you know, children, that kind of thing. So is there any kind of restrictions on [1:16:12, 1:16:16]: What businesses can't or can anyone rent those those spaces? [1:16:18, 1:16:19]: Mr. Coleman, can you respond to that? [1:16:20, 1:16:40]: Certainly. Um there are restrictions on on manufacturing and any kind of um chemical discharge. Um so that's limited. Uh and and we'd be glad to to work with staff on other restrictions and and conditions of approval. What might be helpful, uh Danny, if you're on the call, I th we had a separate [1:16:40, 1:16:46]: presentation that we were going to show you just with some images of some of the buildings. Also had a list of some of the other tenants that we have. [1:16:47, 1:17:07]: give you an an idea of what what we typically see and and and who we would talk to about bringing into this community. Is it possible to to share that presentation? I can flip through it quickly. Hi Linda, yeah I sent that over to you. Uh you said you got it earlier today. If you'd uh please show that or otherwise [1:17:07, 1:17:10]: If you would allow me to share my screen, I could I could put that up as well. [1:17:10, 1:17:12]: Oh okay. So I'll stop sharing then. [1:17:13, 1:17:16]: Oh, okay. Well let me get that ready real quick. [1:17:22, 1:17:25]: Oops. This is Dave Planchon, if I could say a couple things. [1:17:28, 1:17:29]: Sure. Go ahead, Mr. Flash. [1:17:30, 1:17:34]: Um my first question is this is looks to me like it's all warehouse based. [1:17:35, 1:17:38]: By the number of bays they have for trucks, tractor, trailers. [1:17:39, 1:17:42]: Uh my question is we saw a frontage of what the bill [1:17:43, 1:17:47]: Soft images of what the front edge of the building is going to look like. [1:17:47, 1:17:51]: How many truck bays are going to be built behind each building? [1:17:52, 1:17:53]: Any idea with that? [1:17:53, 1:17:54]: perspective yet. [1:17:56, 1:18:16]: Um as a long-term owner, we really look for just maximum flexibility on the site plan. Even those trailer storage areas, they could be car parks. I'm going to show you a picture here in our presentation of a pharmacy that has a fulfillment center that we converted all that area into car parking. Um and that's just for again for flexibility or it could [1:18:16, 1:18:19]: It'd be someone like Wayfair that has [1:18:20, 1:18:25]: Sprinter bands for deliveries, for home deliveries, for for e-commerce. Um [1:18:25, 1:18:30]: It's just flexibility and it could be I mean it could be trucks, but I I'll have [1:18:30, 1:18:34]: I'll I'll get you um a dimension. I it's about [1:18:34, 1:18:35]: About three. [1:18:36, 1:18:46]: Two to three doors for every sixty feet. So I'll have to uh do the math and get back to you on that. So it's gonna be this it's gonna be standard then truck space. That's correct. [1:18:47, 1:18:48]: Yes. Okay. Um [1:18:49, 1:18:50]: M and [1:18:51, 1:19:11]: Parking for the trailers, my I have a problem with your previous presentation where you said about 400 truck trips per day in and out of the development will occur. Um, have you driven down Davison Parkway and just imagine 400 tractor trailers going down that little skinny road? [1:19:11, 1:19:12]: Each and every day. [1:19:13, 1:19:22]: And you mentioned previously that most of the bit of the businesses would be open normal business hours, but then you went on to say that most of the truck business. [1:19:22, 1:19:28]: or truck traffic will be occurring after hours. So I'm kind of confused on that. [1:19:30, 1:19:44]: But right now, Davison Road is not structurally strong enough. Um, either is the intersection, uh your Dairy Queen ice cream is gonna melt before you get to the line to pick it up with the traffic that's gonna create at that stoplight. [1:19:45, 1:19:50]: And there are no other traffic control devices on Davison Parkway between this. [1:19:52, 1:20:03]: development and 138. And there are a number of businesses in there that this is just going to back traffic up terrifically while they're waiting for the stoplight on 138 to change. [1:20:06, 1:20:15]: Yeah, the the number seems high to me. Also, we have other parks in and other cities in the southeast that have a a a one way in with a tr a signal. [1:20:15, 1:20:18]: Uh and they work fine. Um the truck drivers [1:20:18, 1:20:33]: prefer not to be even on the sprinter vans, not to be doing it at peak hours because of of the traffic. That's when we see more cars coming in and out of the park at the peak hours in the morning and the evening than than than trucks. [1:20:33, 1:20:35]: It's worked before um [1:20:36, 1:20:51]: I've got this picture up in Charlotte right now that I'm showing you one way in, one way out. And it's uh just south of the airport. And it's um um it's it's hasn't been has not been an issue. I've I've um [1:20:53, 1:20:57]: My concern with the subdivision up there. [1:20:58, 1:20:58]: Is [1:20:59, 1:21:03]: The approximate thousand cars that come in and out of there every day. [1:21:03, 1:21:05]: Commingling with [1:21:05, 1:21:10]: Not only employee traffic, I think employee traffic here will be minimum. [1:21:10, 1:21:12]: Um, I'm a warehouse manager, so I know [1:21:13, 1:21:14]: How that works. [1:21:14, 1:21:15]: Um [1:21:15, 1:21:16]: But is it truck traffic? [1:21:17, 1:21:21]: Trucks and trucks get along pretty well, but trucks and residential traffic [1:21:21, 1:21:23]: Do not get along and [1:21:23, 1:21:29]: That is really the primary exit there from that subdivision out to 138. [1:21:30, 1:21:31]: And to the interstate. [1:21:33, 1:21:47]: I guess on the flip side, what we like about the use and even our traffic counts is is so it's 1,100 vehicles compared to 7,500 vehicles if this was developed as commercial. So um [1:21:48, 1:21:58]: Ours is a much lower, it's it's it's six times less than that current site plan shows. Yep, I guarante I guarantee more traffic than if it was full blown commercial. That is correct. [1:22:00, 1:22:02]: But it's also a lot more truck traffic. [1:22:05, 1:22:05]: Correct. [1:22:08, 1:22:23]: The the neighborhood does have there there are two ways back out that don't go Davidson Parkway. So the trucks will not allow be allowed to use Walter Way. That that's the primary way that the residents would get access to 138. [1:22:25, 1:22:29]: Mr. Chairman And you know how bad that stoplight is too, right? [1:22:30, 1:22:31]: Miss Miss Johnson. [1:22:31, 1:22:42]: Mr. Plench and um Mr. Chairman, I want to just interject. The applicant has exceeded their 10 minutes of time. If you would like to extend their time, you can do that per a vote. [1:22:43, 1:22:54]: um to allow them additional time with five minutes or 10 minutes to wrap up their presentation before we open it up for the public hearing. So I just want to make that note before they move forward. [1:22:54, 1:22:57]: Mr. uh Mr. Coleman, do you have anything else to add? [1:22:58, 1:23:08]: Uh I would appreciate two more minutes. I just want to flip through the slides real quick, uh, help address your question on the type of tenants and then give you a sense of the architecture. So two minutes would be helpful. [1:23:09, 1:23:11]: Go ahead, Mr. Coleman. [1:23:11, 1:23:20]: Thank you. Um this is a slide show excuse me, John, Mr. Chairman. We just have to have a vote from the from the commission to allow the additional two minutes. [1:23:21, 1:23:35]: Okay. The applicant has requested additional two minutes. He C is 10 minute time to further explain or display some additional slides. Have a motion to approve that. [1:23:35, 1:23:40]: Mr. Chairman, I move that we grant him the addition of two minutes. A second. [1:23:41, 1:23:45]: been moved and second, the applicant is granted the additional two minutes. [1:23:45, 1:23:47]: We we hadn't voted, sir. [1:23:47, 1:23:48]: And loaded. [1:23:49, 1:23:51]: All those in favor, let it be known by the sign of vibe. [1:23:51, 1:23:55]: Aye. Those opposed? The ayes have it. The motion is carried. [1:23:57, 1:23:58]: Go ahead, Mr. Coleman. [1:23:58, 1:24:18]: Thank you. And Danny, we'll just flip through these. This first slide just gives you an example. If there was a question about the type of customers' tenants, so here you can see on the retail side, we have Tesla, Best Buy, Coca-Cola, Wayfair, pharmaceutical companies below there, Walgreens, Blue Cross, Blue Shield, you know, food service and technical. We've had some call centers. [1:24:18, 1:24:26]: Centers here, but also some uh data centers that have very low traffic volume that just use this the space for wires in and out. Uh next slide, please. [1:24:30, 1:24:34]: I talked a little bit about who we are already. You know, uh, we can move on to that, on to the next slide. [1:24:37, 1:24:44]: Thank you. Uh more examples of of customers, uh some some trade shows related to the convention center. Um [1:24:44, 1:25:01]: good good space for that. I talked about entertainment, universal, oceaneering, Norwegian, um home builders. So some of them like to have showrooms in these spaces where they can have their cabinets. And if you're buying building a new home, your the customers for those homes will come and pick out their finishes. Next slide, please. [1:25:02, 1:25:04]: Um, let's keep going, please. [1:25:05, 1:25:13]: And just want to show you, this is our footprint uh in the southeast, the Sunbelt uh cities I mentioned. Uh our corporate office is located in Jackson, Mississippi. [1:25:13, 1:25:15]: Uh next slide, please. [1:25:15, 1:25:35]: And these are just some examples of buildings that have the same look. You mentioned the front. We like to brag on the front where the well is you'll see multiple entries because we have multiple uh tenants in a lot of these buildings. Again, long-term flexibility. This is in Miami. Uh next slide, please. Uh Orlando, uh again, very focused on the architecture over uh code. [1:25:35, 1:25:45]: minimum uh landscaping. This would be the view of the buildings from the interstate. So I think a nice gateway into the city of Stockbridge. Next slide, please. [1:25:45, 1:25:48]: Uh same park at night, the focus on nighttime lighting also. [1:25:49, 1:26:00]: Uh next slide. Uh another park. This park is uh 15 years old. So again, as a long-term owner, we try to put a lot of architecture and pizzazz in the buildings that will survive the tests of time. [1:26:00, 1:26:01]: Uh next slide, please. [1:26:02, 1:26:08]: Uh the park we already looked at in Charlotte, uh very similar proximity to residential area has been very well received. [1:26:09, 1:26:14]: Uh next slide, please. Uh building that we did up I think two minutes is is is expired. [1:26:14, 1:26:16]: Okay. Thank you. [1:26:20, 1:26:24]: And we have a vote on have um a motion on the vote of this application. [1:26:26, 1:26:35]: Mr. Chairman, my apologies. Um, we would need to um close discussion with the applicant and open it open up the public hearing at this time. [1:26:35, 1:26:40]: For ten minutes for those who want to speak in favor and then ten minutes for those who would like to speak in opposition. [1:26:41, 1:26:42]: Okay. [1:26:43, 1:26:45]: We open up to public comment. [1:26:48, 1:26:49]: On the uh [1:26:49, 1:26:50]: Project. [1:26:53, 1:27:01]: If you would like to raise your hand, we do have IT on the call to acknowledge you, or if you can put your question in the chat, we can address it that way. [1:27:10, 1:27:12]: We haven't one online for public public comment. [1:27:16, 1:27:20]: I do not see, oh I do see a question in the uh chat. [1:27:20, 1:27:23]: From Miss Denita Minnes. [1:27:24, 1:27:27]: And her question is, how long will it take to finish? [1:27:28, 1:27:30]: Guessing is as far as the project is concerned. [1:27:35, 1:27:55]: Would you like me to answer? Yeah. Okay. Um, thank you. Um yes, we will move immediately since these are all spec buildings. We'll move immediately into construction. We'll start with the first two buildings. Uh just how quick we can get these permitted um and and under construction. I think we do have to go through a platting process, a consolidation plat, uh, which we're we're fine with. [1:27:55, 1:28:03]: With uh so we will move um, we will start with the first two buildings and just work down the I'm guessing three to five years at the longest. [1:28:05, 1:28:06]: Okay. [1:28:07, 1:28:13]: Okay, um I have another question uh from I have a raised hand actually from Mr. Evan Atkinson. [1:28:14, 1:28:16]: Yes, can you all hear me? [1:28:16, 1:28:17]: Yes, that we can. [1:28:17, 1:28:37]: Uh yeah, I'm just speaking as a as a resident of North Bridge Crossing. Um I just had a few concerns that I wanted to to note um owning a home in the neighborhood for the last um two years. Um I know from my standpoint I'm concerned about the um the emergency exit um of this facility being so close to our HOA amenities. Um we have a lot of children. [1:28:37, 1:28:57]: In the neighborhood. Um, and of course, they're the main members that use the um the pool and the park and the basketball court. And I do see that an emergency exit on I believe Walter Way is is is pretty close to that. And as y'all mentioned, the um the drivetime trucks already go through the neighborhood, and we do have a lot of children that like to ride their bikes and and use these things. [1:28:57, 1:28:59]: Um [1:28:59, 1:29:19]: Also additionally, definitely have um some current uh concerns about um the company truck drivers um that we of course do we don't know the tenants that are going to be um occupying these spaces. So I do think it's it's hard to determine if they will actually adhere to the rules that Mr. Coleman says. Um I would do [1:29:19, 1:29:39]: Have concerns that they would try to use the emergency exit or different exits because of course there won't be like policing of those kind of um entrances and exits um in reality. Um so I would be have concerned about using that if that's a faster way in. Um and I know people have already uh mentioned about um Davidson traffic. I know for [1:29:39, 1:29:55]: For for me and my wife, you know, part of the reason why we also moved to this neighborhood was the access to 675 and 75. And of course, that would be another burden on the homeowners and tenants of this neighborhood because we also want, you know, want to make left down Davidson. [1:29:55, 1:30:05]: um as well. And I know that that is where the majority of the uh the traffic would go. And I know with some of the trucks there already is some backup at that light when we start getting to one thirty eight. [1:30:05, 1:30:25]: Um and I uh the last point that I would like to make is that um definitely agreed that if this was used for a commercial space, um that there probably would be more additional traffic, but I at least could see it as being more beneficial for folks that do live in the neighborhood to be able to use certain businesses or um what was used in place if it's a hotel or coffee shop or however it was used. [1:30:25, 1:30:29]: Um but that's it. [1:30:30, 1:30:31]: a homeowner in this community. [1:30:34, 1:30:38]: D can we respond to the just the questions now or do we need to wait? [1:30:39, 1:30:59]: You can respond now. Just one thing on the emergency access. I wanted to to that that will be gated with um what they call a knox box, which allows fire department access only. So that will be restricted where really it could only be accessed by by emergency personnel, by the fire or police and in [1:30:59, 1:31:01]: in case there was an emergency. [1:31:04, 1:31:05]: No. [1:31:06, 1:31:07]: Any other comments? [1:31:08, 1:31:26]: Yeah, so we have another one from um Miss again, Miss Denita Minnes. The question is, are you aware of the homeless situation in that area? There have been tents set up in the wooded areas recently. I'm Danita Millis, the HOA president for the board of directors for North Bridge Crossing community. [1:31:30, 1:31:32]: John, do you want to handle that or or? [1:31:32, 1:31:52]: Um sure. Uh John Coleman. Um we had we I had not been aware of it, but we heard it's one of the community calls that we had, one of the two prior community meetings. I obviously that would be a big concern with ours. Uh we have that on a property down in Orlando. Um two things. One, the the development of the site itself tends to solve that problem. [1:31:52, 1:31:56]: because it's cleared and that that area is no longer [1:31:57, 1:32:08]: as as concealed. Um and then as the long term owner, we will be very proactive. I'm officed in Atlanta, our property management team's office in Atlanta on on on [1:32:08, 1:32:21]: policing that area and and and and making sure especially that buffer area it's a pretty big buffer area we would work with the the adjacent uh association property owners association work together to make sure that that would be [1:32:22, 1:32:23]: Be resolved. [1:32:29, 1:32:39]: Those are all the questions we have in the Q<unk>A box and I don't see any other raised hands. Uh we would just need for folks, I think those are folks that spoke. [1:32:39, 1:32:48]: Kind of half and half and mostly questions. Um, but I guess we can close the public hearing for folks in favor and then open it up for those who are in opposition. [1:32:49, 1:32:52]: All right, the public comment is now closed. [1:32:54, 1:33:01]: Sure, we would need to open it up for those who would like to speak in in opposition to the request. I thought I thought they were both what are you saying they were questioned a one in one. [1:33:02, 1:33:07]: Yes. Yes. Okay. Well, let's have those in opposition to the development. [1:33:08, 1:33:10]: I am looking to see who we have here. [1:33:20, 1:33:25]: Okay, I don't see any additional hands raised or questions in the chat. [1:33:27, 1:33:29]: So yes, sir, I guess we can close the public hearing portion. [1:33:31, 1:33:32]: Okay, the uh [1:33:33, 1:33:35]: Public comment has been closed. [1:33:37, 1:33:37]: Um [1:33:39, 1:33:41]: Board members have any further comments? [1:33:42, 1:33:44]: Yeah, sure uh uh [1:33:45, 1:33:46]: President Mass speakers Harold. [1:33:46, 1:33:47]: Sure, go ahead. [1:33:48, 1:33:53]: Uh is it possible for us to put any some type of amendment in in there? [1:33:54, 1:33:57]: uh given an opportunity if they can uh [1:33:58, 1:34:01]: Reroute that traffic out of the subdivision from drive time. [1:34:02, 1:34:03]: Ahora [1:34:03, 1:34:06]: Like to at least have that in there if we can get [1:34:06, 1:34:09]: If there's an opportunity that will come up or possibly come up. [1:34:10, 1:34:12]: that that could happen. So [1:34:13, 1:34:14]: I don't I don't think we should just [1:34:15, 1:34:17]: Leave it as is, uh [1:34:17, 1:34:19]: I think we have a great opportunity here. [1:34:20, 1:34:23]: And maybe we need to put something in there for that. [1:34:23, 1:34:27]: Well I I I think what you're saying possibly that we should [1:34:28, 1:34:30]: table is to allow them to address those issues. [1:34:32, 1:34:35]: No, I I think we should put some stipulation on. [1:34:35, 1:34:36]: Oh on it. [1:34:37, 1:34:39]: For an opportunity. [1:34:39, 1:34:41]: If given, I mean uh [1:34:41, 1:34:43]: They're buying a property and [1:34:43, 1:34:44]: And putting up [1:34:44, 1:34:46]: builders and everything, but I [1:34:46, 1:34:47]: I think we should [1:34:48, 1:34:55]: put something in there if they have the opportunity to work it out to relieve the commercial traffic out of their neighborhood. [1:34:55, 1:34:57]: That would be my suggestion. [1:34:57, 1:35:00]: I I wouldn't want to table it. I think it's an opportunity. [1:35:04, 1:35:24]: So, uh, Chairman, if I may, um to to to Mr. Thibodeau's point, yes, we we can make amendments to the zoning conditions as stated. Um, while we were talking, I did come up with some verbiage. And if you let me know if this is along the lines that you're looking for as a statement. [1:35:24, 1:35:25]: stipulation. [1:35:25, 1:35:35]: Um the condition would be applicant shall coordinate with drive drivetime owners to consider rerouting vehicular traffic. [1:35:35, 1:35:36]: were feasible. [1:35:38, 1:35:40]: Um I want to just [1:35:40, 1:35:44]: Does that does that work? Because we're we're basically wanting to reroute traffic. [1:35:47, 1:35:50]: Out of subdivision, out of of subdivision. [1:35:51, 1:35:55]: Uh correct that feasible. Yes, that would be correct. [1:35:55, 1:36:05]: Okay, so let me restate that for the record so that it's clear. Applicants shall coordinate with drivetime owners to consider rerouting vehicular traffic. [1:36:06, 1:36:08]: out of subdivision if feasible. [1:36:12, 1:36:13]: Yeah. [1:36:14, 1:36:17]: Is that the design? The only problem is when you say feasible. [1:36:18, 1:36:22]: Uh you you're giving them too much latitude. I I would say [1:36:23, 1:36:23]: Uh. [1:36:24, 1:36:25]: Прсуда опотуні. [1:36:27, 1:36:27]: That [1:36:27, 1:36:30]: can or wouldn't make it possible versus [1:36:32, 1:36:33]: Feasible uh [1:36:33, 1:36:38]: Okay. That may put a little bit more bite in versus uh saying feasible. [1:36:39, 1:36:40]: That would be market center. [1:36:41, 1:36:46]: Okay, so then we want to do it based on the um topographic constraints. [1:36:46, 1:36:51]: So they would have to put something in place and the only way that they wouldn't. [1:36:52, 1:36:55]: I I guess would be if they couldn't come up with an agreement with drive time. [1:36:55, 1:36:56]: or if [1:36:56, 1:37:00]: Topographically and actually they are not able to [1:37:00, 1:37:03]: make the code cut to remove that traffic. [1:37:04, 1:37:06]: I think that the city [1:37:07, 1:37:12]: Uh uh y I think that's that's apple what you're saying, but I also think the city should [1:37:12, 1:37:15]: Атліст тріти лев да ситуація. [1:37:16, 1:37:16]: Uh [1:37:16, 1:37:19]: Considering that it is a neighborhood. [1:37:19, 1:37:21]: And consider that they have. [1:37:21, 1:37:23]: really unwanted uh commercial traffic. [1:37:24, 1:37:26]: Traffic running through that neighborhood. [1:37:26, 1:37:28]: That really shouldn't never happen. [1:37:29, 1:37:29]: Mm-hmm. [1:37:30, 1:37:32]: So then we can remove remove the statement. [1:37:33, 1:37:44]: if feasible or where feasible completely and just require them to make the coordination between um the drivetom owner to consider rerouting vehicular traffic. [1:37:44, 1:37:46]: out of the subdivision and period. [1:37:47, 1:37:53]: And they'll be required to do that as part of this if you if the board deems it. [1:37:53, 1:37:56]: Um what you would like to recommend for approval. [1:37:57, 1:37:58]: Yes. Okay. [1:37:59, 1:37:59]: Uh. [1:37:59, 1:38:07]: I'm sorry to interrupt. This is John Coleman. There there are certain state and environmental issues that that pose [1:38:08, 1:38:21]: uh uh uh the the that would be destroying those those restricted preserved areas which we may have no control over in addition to the topo um and then you've got drivetime that [1:38:22, 1:38:24]: We'll have to of course agree to [1:38:24, 1:38:25]: To work with [1:38:26, 1:38:38]: Those different selections. That's what the what it's asking for. I mean, of course, those conditions will make it where it makes it difficult. Um [1:38:39, 1:38:43]: however the the condition will be to coordinate that effort. [1:38:43, 1:38:47]: So that if there is a way that it can be done, that it it is done. [1:38:47, 1:38:57]: Okay. And we would also look at options that would go to the south and and and look at coordinating efforts through Henry County to the south too. So I think there's multiple solutions we can look at. [1:38:59, 1:39:02]: I I agree to that. As long as we're pursuing it. [1:39:03, 1:39:05]: А те' сам опція на тайбо. [1:39:05, 1:39:07]: I'm agreeable with that. It's it's [1:39:08, 1:39:13]: If we don't do anything, then nothing's gonna happen, or we don't put anything in motion. [1:39:13, 1:39:14]: Nothing's gonna happen. [1:39:15, 1:39:16]: And at the end of the day. [1:39:16, 1:39:20]: It's gonna we're still gonna have commercial traffic running through the neighborhood. [1:39:21, 1:39:23]: And and I think what I'm saying. [1:39:24, 1:39:25]: It is feasible. [1:39:26, 1:39:27]: Uh consider [1:39:27, 1:39:31]: That that kind of behavior should never happen in their neighborhood. [1:39:32, 1:39:34]: Regardless of the grandfather the end time. [1:39:35, 1:39:41]: i i i if there's a opportunity that exists, I think as a as a planning zoning commission board. [1:39:41, 1:39:44]: We should pursue it and try to seize that opportunity. [1:39:45, 1:39:46]: For the citizens. [1:39:46, 1:39:47]: In the community. [1:39:50, 1:39:53]: I can encourage you, Mr. Tibetok. I I think uh when we roll through there. [1:39:54, 1:39:56]: Uh, we looked at some of those. [1:39:56, 1:39:57]: Options. [1:39:57, 1:40:00]: Uh, but it would be up to them to uh [1:40:01, 1:40:02]: To see it. [1:40:02, 1:40:06]: In order uh and and as a condition of approving this. So [1:40:07, 1:40:08]: I concur with you. [1:40:10, 1:40:11]: Mr. Chairman. [1:40:12, 1:40:14]: Mr. Mr. Dumas, go ahead. [1:40:16, 1:40:18]: The staff has really prepared [1:40:19, 1:40:20]: A detail [1:40:20, 1:40:35]: report on this project. And I would just like to applaud them for giving us the kind of detail that they did, uh referencing all the studies and the land use and et cetera, et cetera. Um [1:40:36, 1:40:42]: Rarely do I vote against what staff recommends. [1:40:43, 1:40:47]: Because they are the experts. We rely on them. [1:40:49, 1:40:51]: To cross the T in the doctor eyes. [1:40:53, 1:40:56]: And I was really looking forward to this meeting. [1:40:58, 1:41:00]: To hear what the applicant [1:41:00, 1:41:01]: Had to say. [1:41:02, 1:41:04]: Although I did attend one of the public. [1:41:05, 1:41:06]: community meetings before. [1:41:07, 1:41:08]: But I wanted to hear. [1:41:09, 1:41:17]: something that would allow me to become a supporter of this rezoning. [1:41:18, 1:41:30]: Uh that's a big hurdle to to cross. I mean, there's no point in having staff if we're not gonna rely on that professional expertise to. [1:41:30, 1:41:31]: Get it right. [1:41:32, 1:41:33]: And they have [1:41:35, 1:41:37]: Already say that they recommend denying this. [1:41:39, 1:41:40]: And [1:41:40, 1:41:43]: I I haven't heard anything tonight that [1:41:45, 1:41:46]: Make me want to go against their [1:41:50, 1:41:51]: So that's where I am. [1:41:51, 1:41:54]: I agree with you, Mr. Doomsa. They did that's a detailed report. [1:41:55, 1:41:57]: And they've really uh laid out. [1:41:58, 1:42:00]: Uh their basis for denying it. [1:42:01, 1:42:04]: I uh Mr. Tibetore and I rode over there. [1:42:04, 1:42:08]: to uh look at the property. And my major concern was that community that I wouldn't want [1:42:09, 1:42:13]: that level of volume of vehicle traffic passing through my neighborhood as well. [1:42:13, 1:42:16]: And that would be my opposition to it. [1:42:16, 1:42:19]: May I may I'm sorry? Go ahead. [1:42:20, 1:42:25]: And and and I don't disagree with you on that. In fact I agree wholeheartedly, but I also [1:42:26, 1:42:29]: have a feeling that this project [1:42:29, 1:42:35]: would negatively affect the existing businesses, which nobody's talking about. [1:42:35, 1:42:39]: the existing businesses that are already in that area. [1:42:41, 1:42:45]: I think they will be adversely impacted with the traffic. [1:42:47, 1:42:48]: And [1:42:50, 1:42:53]: I don't see how it could benefit the businesses or the community. [1:42:54, 1:42:57]: or the residents, I should say, because we all community. [1:42:58, 1:43:04]: But the residents and the and the businesses that are located in that general vicinity uh [1:43:05, 1:43:07]: could be adversely affected as well. [1:43:08, 1:43:09]: For this project. [1:43:10, 1:43:11]: May I speak, Mr. President? [1:43:12, 1:43:13]: It's two at all, we'll hear. [1:43:14, 1:43:14]: Um [1:43:15, 1:43:16]: At some point. [1:43:16, 1:43:19]: We have to look we have to trade off. [1:43:20, 1:43:25]: uh what's gonna benefit the area and and when we talking about employees [1:43:26, 1:43:28]: Uh, people need a place to eat. [1:43:28, 1:43:29]: And uh [1:43:30, 1:43:32]: I think it would add [1:43:32, 1:43:33]: uh to the community [1:43:34, 1:43:35]: Providing that uh [1:43:35, 1:43:38]: There's some consideration that we can work out. I [1:43:39, 1:43:45]: I don't I it since it's warehousing and I know uh Mr. Plaster has a lot of experience about warehouses, so do I. [1:43:46, 1:43:48]: I I would see it as an asset. [1:43:48, 1:43:48]: to that. [1:43:49, 1:43:50]: Particular area. [1:43:50, 1:43:54]: And I would also see it as as providing more revenues. [1:43:55, 1:43:55]: Uh [1:43:56, 1:43:57]: To the city. [1:43:57, 1:44:00]: and to the surrounding areas for uh [1:44:01, 1:44:01]: Having uh [1:44:02, 1:44:05]: individuals working and being able to eat. [1:44:05, 1:44:06]: And sleep in that area. [1:44:07, 1:44:09]: And as far as the traffic, uh [1:44:09, 1:44:12]: Considering what he's telling me, what they're gonna do in the building. [1:44:13, 1:44:14]: Well, we may not have that kind of [1:44:15, 1:44:16]: Kind of traffic it. [1:44:16, 1:44:17]: Uh [1:44:17, 1:44:18]: There's a possibility. [1:44:19, 1:44:25]: I I'm not the expert. I know we're supposed to disseminate this information and and and make a decision. [1:44:26, 1:44:26]: Uh [1:44:27, 1:44:29]: Бу стіл have to consider. [1:44:30, 1:44:31]: The property. [1:44:31, 1:44:33]: the revenues, the impact. [1:44:34, 1:44:40]: and and what it's actually bringing to the community. That would be my consensus about uh the warehouse. [1:44:40, 1:44:43]: Warehousing does not necessarily [1:44:43, 1:44:48]: mean that there's a lot of traffic. It depends on what they're doing in in those warehouses. [1:44:48, 1:44:53]: And that's really a small track compared to some of the other warehouses that we have in the area. [1:44:58, 1:45:00]: Mr. Platter, can you add anything to that? [1:45:03, 1:45:04]: It's a pleasure. [1:45:06, 1:45:22]: Yes. Again, uh warehousing means there's no taxes, there's no sales, there's no sales taxes going to the community. Um now I and I'm not all negative on this. I hate to see this proposal denied. [1:45:22, 1:45:30]: because of lack of infrastructure around the area to support it. It would be good for the community. [1:45:31, 1:45:51]: It would be a good use of that piece of property because it is so close to the interstates. Um, I hate to see all the trucks though not going to six seventy-five, but trying to stay on 138 to get to 75. I don't think anybody would really do that, but whichever direction you were gonna go. Um [1:45:51, 1:46:00]: Again, I I hate to see this proposal not succeed, but not for its own fault. [1:46:00, 1:46:08]: Because of the surrounding infrastructure and like you said, the businesses up and down Davison Parkway that would be impacted by the traffic. [1:46:20, 1:46:22]: Well, entertain a motion for [1:46:22, 1:46:23]: First of all. [1:46:23, 1:46:29]: Mr. Uh Thibodeau has laid out along with uh Ms. Johnson some conditions for [1:46:29, 1:46:31]: The approval of this applicant. [1:46:33, 1:46:34]: And uh thank [1:46:35, 1:46:37]: That was articulated well. [1:46:37, 1:46:41]: Uh, think the applicant know what the h his his obligation is henceforth. [1:46:42, 1:46:46]: And uh that the application will be conditioned upon that. [1:46:47, 1:46:48]: So [1:46:48, 1:46:50]: I have a motion on the application. [1:46:55, 1:46:57]: I I would uh [1:46:57, 1:46:59]: Make a motion that we pass. [1:47:00, 1:47:01]: The uh zoning for that. [1:47:02, 1:47:06]: And uh I I'm looking at it from a different a lot of angles. [1:47:06, 1:47:13]: I I don't think that the the the impact would be as great. I think the biggest impact is the neighborhood traffic. [1:47:13, 1:47:19]: that's going for drive time. I think if if there's some consideration between those two entities. [1:47:20, 1:47:25]: I think it would resolve a lot of issues that's going in that area. But but we have to also look at [1:47:26, 1:47:26]: Uh [1:47:27, 1:47:28]: Anything next to the freeway [1:47:29, 1:47:31]: Із конабі коммерціази аксе. [1:47:32, 1:47:32]: Uh [1:47:33, 1:47:34]: We could [1:47:34, 1:47:35]: We can change streets. [1:47:36, 1:47:36]: Uh [1:47:37, 1:47:38]: We can put in different things. [1:47:39, 1:47:42]: But we have to give business an opportunity, uh [1:47:43, 1:47:47]: in certain areas. And I think that's one of the areas that we need to uh [1:47:48, 1:47:55]: give a business uh an opportunity to develop itself and it it it can support the surrounding areas. [1:47:56, 1:47:59]: where there's pa patrons going to eat [1:48:00, 1:48:01]: Exercise shop. [1:48:02, 1:48:04]: So I I don't see it as a as a total waste. [1:48:05, 1:48:05]: Uh [1:48:05, 1:48:07]: I think it's a great opportunity. [1:48:07, 1:48:08]: From a [1:48:08, 1:48:09]: Bitness perspective. [1:48:12, 1:48:15]: Well, Mr. Tibodeau, uh, can I get a motion from you? [1:48:16, 1:48:17]: Or approved. Yeah. [1:48:17, 1:48:20]: I'd like the motion that we change the zoning. [1:48:20, 1:48:21]: Uh. [1:48:21, 1:48:22]: To the property. [1:48:23, 1:48:25]: And that we put the stipulations that we uh [1:48:26, 1:48:28]: talked about as for as trying to uh [1:48:28, 1:48:30]: relieve the traffic. [1:48:30, 1:48:32]: out of uh the sub debate. [1:48:33, 1:48:34]: Yeah, but second. [1:48:37, 1:48:38]: I'll second it. [1:48:40, 1:48:41]: Yeah, proven. [1:48:43, 1:48:46]: All those in favor, let it be known by a sign of aye. [1:48:47, 1:48:47]: Right. [1:48:48, 1:48:48]: Right. [1:48:50, 1:48:51]: Those opposed? [1:48:51, 1:48:52]: Bye. [1:48:53, 1:48:53]: Hi. [1:48:58, 1:49:03]: Mr. P I my computer wouldn't unmute, sorry. Are you voting for approval? [1:49:05, 1:49:05]: Denial. [1:49:06, 1:49:06]: Venam. [1:49:08, 1:49:10]: It's been uh [1:49:11, 1:49:12]: Moved and second. [1:49:16, 1:49:17]: The emotion is denied. [1:49:18, 1:49:20]: The the the application is denied. [1:49:28, 1:49:32]: Okay, thank you, Jim. Excuse me, may I get clarification on what this vote is? [1:49:33, 1:49:35]: Vote was on the approval of the application. [1:49:36, 1:49:39]: We have two for and three against. [1:49:40, 1:49:43]: Right. So uh for the record, uh Chairman, if I may. [1:49:43, 1:49:44]: Um [1:49:45, 1:49:46]: Mr. Thibodeau. [1:49:47, 1:49:48]: Requested the um [1:49:49, 1:49:50]: The motion for approval. [1:49:51, 1:49:53]: Correct. Chairman Abdullah seconded it. [1:49:53, 1:49:56]: And he asked for all those for the vote. [1:49:56, 1:50:02]: And the those who were opposed were um Mr. Planchin, Ms. Nelson, and Mr. Dilmis. [1:50:03, 1:50:05]: So there's a three two vote for denial. [1:50:06, 1:50:08]: Correct. Mr. Chairman [1:50:10, 1:50:14]: Mr. Chairman. Go ahead, Mr. If I may, if I may interject. I believe [1:50:15, 1:50:17]: Mr. Planch on second that motion. [1:50:18, 1:50:25]: No, I seconded it. You seconded it? Yeah. I'm sorry. Yeah, Mr. Plancher. Mr. Planter voted for denial. [1:50:25, 1:50:32]: You voted for denial and Miss Nelson voted for denial. I I got that. I just uh I just thought I heard him s second the motion. Uh uh. [1:50:33, 1:50:35]: I'm sorry. Okay. [1:50:36, 1:50:41]: That's it. Is that as that vote failed, wouldn't you have to take a new vote for [1:50:41, 1:50:50]: approval i mean uh of denial of the application because we've already voted the vote the vote is passed past three two d denial [1:50:50, 1:50:56]: Yeah now. At this point, but we do have the next item for the comprehensive plan amendment, and that also is a public hearing. [1:50:59, 1:51:00]: That is [1:51:02, 1:51:05]: Are you ready to move forward with that item, Chairman? [1:51:05, 1:51:10]: Yeah, we can move forward with it. Okay. Linda, please read um the public hearing into the record. [1:51:12, 1:51:16]: Okay, comprehensive plan amendment case number CP. [1:51:17, 1:51:22]: two oh two one IFON O ON the City of Stockbridge Planning Commission and the City of Stockbridge Mayor and City Council. [1:51:23, 1:51:29]: We'll hear a comprehensive plan amendment request by East Group Properties LP, the applicant to change a future land use designation. [1:51:30, 1:51:33]: of certain property from low density vertical mixed use. [1:51:33, 1:51:39]: to light industrial to allow for the development of a business distribution center within five new buildings. [1:51:39, 1:51:44]: properties locating landlock fifty seven of district twelve within the stockbird city limits. [1:51:44, 1:51:45]: Um [1:51:45, 1:51:46]: Yeah. [1:51:47, 1:51:52]: contains three parcels of seventy nine point one seven plus or minus total acres as follows. [1:51:53, 1:51:54]: Should I read these again or [1:51:56, 1:51:58]: Parcel number. [1:51:59, 1:52:10]: Parcel number 030-01009000 contains 73.88 acres located to the rear of the southwest corner of Davidson Parkway and Walter Way. [1:52:10, 1:52:16]: Parcel number 030, hyphen 01009006 contains 1.66 acres. [1:52:16, 1:52:21]: Located on the south side of Davidson Parkway, one lot west of Walter Way. [1:52:21, 1:52:26]: And parcel number O three O hyphen O one O nine O five. [1:52:26, 1:52:28]: Contains three point six three acres. [1:52:29, 1:52:33]: Located on the west side of Walter Wade, two lots south of Davidson Parkway. [1:52:34, 1:52:37]: It was noted that the applicant wishes to remove [1:52:37, 1:52:45]: The third parcel with 3.63 acres. That's parcel number 030 hyphen 01009005. [1:52:50, 1:52:56]: Um I have another PowerPoint presentation uh to give. [1:53:00, 1:53:02]: Let me um share my screen with that. [1:53:06, 1:53:08]: Okay, everyone can see that. [1:53:09, 1:53:09]: Mm. [1:53:11, 1:53:15]: Everyone can see that. Um, we have some of the same information. [1:53:16, 1:53:17]: As before. [1:53:17, 1:53:23]: With the appricant and location and size and everything. The comprehensive plan amendment request again is to [1:53:23, 1:53:32]: Change properties future land use designation from low density vertical mixed use to light industrial to allow the rezoning of a property from C3 to M1. [1:53:33, 1:53:37]: Um, we've gone through the existing uses and so forth. [1:53:38, 1:53:40]: We've looked at the aerial photo. Now I'm gonna show you. [1:53:41, 1:53:47]: This is a Stockridge future land use map of the whole city. Our subject site is here in this pink area. [1:53:47, 1:53:50]: Can see that that is the low density vertical mixed use. [1:53:51, 1:53:52]: adjacent to it. [1:53:52, 1:54:01]: To the east in this um dark orange is high density residential. That's the that's the North Bridge crossing, the residential. And we have um [1:54:02, 1:54:03]: Enlargement of that here. [1:54:04, 1:54:04]: On this slide. [1:54:05, 1:54:07]: The colors. Colours are different on this. [1:54:08, 1:54:08]: But um [1:54:09, 1:54:11]: This is the main site in here. [1:54:11, 1:54:13]: And then North Bridge. [1:54:13, 1:54:15]: Um here in the high density residential. [1:54:18, 1:54:32]: Uh let's see, we already went through existing land use. Um, we talked about what the applicant's requests are. I want to mention here importance of a property's future land use designation relative to its zoning classification. [1:54:32, 1:54:35]: So a proposed zoning district must be permitted. [1:54:36, 1:54:42]: within the property's future land use designation. Now the pro the comprehensive plan is a [1:54:42, 1:54:45]: is a a is a lengthy report. [1:54:45, 1:54:46]: Um [1:54:46, 1:54:50]: with recommendations for the future development of the city and then it [1:54:50, 1:54:56]: It includes different uh land use uh designations throughout the city. Um [1:54:57, 1:54:58]: Four different properties. [1:54:58, 1:55:03]: Uh it also noted that new developments should promote a better sense of place and preserve [1:55:03, 1:55:05]: value and community character. [1:55:06, 1:55:08]: Uh see we had the site plan. [1:55:09, 1:55:10]: And then um [1:55:10, 1:55:18]: Couple of things on definitions, low density vertical mixed use should mainly serve residents of the surrounding residential neighborhoods. [1:55:18, 1:55:22]: And should have a community-oriented feel of the for these areas. [1:55:22, 1:55:23]: Um [1:55:23, 1:55:29]: So that's the purpose of the the existing land use designation. Now the light industrial, this is what [1:55:30, 1:55:33]: the applicant is requesting so that they can rezone to M1. [1:55:35, 1:55:43]: Is intended for business parks, which uh incorporate a warehouse and light manufacturing operations. So this is why we said that. [1:55:43, 1:55:45]: Uh for for in order to [1:55:45, 1:55:50]: Rizona M1, they have to change the land use designation to light industrial. [1:55:50, 1:55:51]: Just want to mention here. [1:55:52, 1:55:57]: Uh purpose of C three district is to provide commercial activities, providing services. [1:55:57, 1:56:00]: requiring locations near major roads and highways. [1:56:00, 1:56:04]: Which are not appropriate located in C one, C two districts. [1:56:04, 1:56:08]: And the M1 district purpose is to provide for industri light industrial uses. [1:56:08, 1:56:11]: They're nuisance free and not generators of [1:56:11, 1:56:15]: hazardous waste and they should be near major uh thoroughfares as well. [1:56:17, 1:56:21]: Uh we rec staff recommends the denial of the comprehensive plan amendment. [1:56:21, 1:56:23]: Uh, for the subject property. [1:56:23, 1:56:24]: Um [1:56:25, 1:56:28]: And uh mention uh however [1:56:28, 1:56:29]: What we talked about before. [1:56:30, 1:56:32]: that uh we feel the property is better. [1:56:32, 1:56:38]: served in uh commercial uses as it's properly currently zoned and the current land use destination. [1:56:39, 1:56:41]: Uh however if uh [1:56:41, 1:56:47]: Uh board desires to approve this. It should be only approved if the rezoning is approved and with the [1:56:48, 1:56:49]: conditions um [1:56:50, 1:56:52]: that were mentioned in in the rezoning. [1:56:53, 1:56:54]: Uh staff report. [1:56:56, 1:56:58]: Uh any questions about this? [1:57:01, 1:57:02]: No, I think uh [1:57:03, 1:57:07]: We address this when we deny the the zoning. So [1:57:08, 1:57:08]: Uh [1:57:09, 1:57:12]: Uh I can't possibly see approving this and we've already denied the zoning. [1:57:13, 1:57:16]: Right. Well they go hand in hand. [1:57:16, 1:57:17]: All right. [1:57:18, 1:57:26]: So Mr. Chairman, uh with it with it being a public hearing, will we still have to go through the same um process um to allow the applicant to speak? [1:57:27, 1:57:32]: Um and from there we have to open it up for public comment. Um [1:57:32, 1:57:34]: for the public hearing for those who want to speak in. [1:57:34, 1:57:38]: favor and those who want to speak in opposition ten minutes each. [1:57:39, 1:57:41]: Okay, um let me say this. [1:57:42, 1:57:44]: I got a appointment at eight thirty. [1:57:44, 1:57:48]: And so I'd like to leave uh Mr. Thibodeau as the chair. [1:57:48, 1:57:49]: And excuse myself. [1:57:50, 1:57:52]: And he has my vote. [1:57:53, 1:57:54]: Mr. Thibodeau. [1:57:55, 1:57:57]: Yes, sir. I'm listening. I he [1:57:58, 1:57:58]: Okay. [1:58:00, 1:58:04]: Uh, my my only problem is if we go on through the same thing and we took the first [1:58:05, 1:58:06]: meeting and and [1:58:06, 1:58:09]: decide not to change the zoning on. [1:58:09, 1:58:11]: Are we just going through the motion? [1:58:11, 1:58:15]: Well yeah, we have to go through the motion, but my point is I'm leaving you as the chair. [1:58:15, 1:58:17]: Because I I have an eight thirty appointment. [1:58:18, 1:58:19]: That's that's fine. [1:58:20, 1:58:20]: Okay. [1:58:21, 1:58:22]: All right, thank you very much. [1:58:22, 1:58:23]: Thank you. [1:58:23, 1:58:23]: Okay. [1:58:35, 1:58:37]: All right. We can continue. [1:58:43, 1:58:45]: Discussion you're muted. [1:59:00, 1:59:03]: So um Mr. Thibodeau, um the [1:59:04, 1:59:08]: Next portion would be to if you do want to allow the applicant to speak. [1:59:08, 1:59:11]: If you want to go into the public hearing, we can do that also. [1:59:12, 1:59:13]: So um [1:59:15, 1:59:16]: At your leisure. [1:59:17, 1:59:24]: Well, I I wouldn't have a problem giving the applicant an opportunity to speak, but if you wanna go into the public, uh [1:59:25, 1:59:27]: comments, I'm I'm all for that also. [1:59:28, 1:59:31]: No, the apple the applink should have an opportunity to speak if if you would allow them. [1:59:32, 1:59:34]: Yes, uh I I would allow the app. [1:59:35, 1:59:35]: Yeah. [1:59:36, 1:59:37]: John or Michelle? [1:59:38, 1:59:41]: Sure, I'm gonna Michelle but I'll let Michelle jump in. Yeah. [1:59:42, 1:59:48]: Michelle Battle with Battle Law. Um I apologize that I was unable to stay on the call earlier. [1:59:48, 1:59:53]: Hoping we would have been able to get to speak before uh seven o'clock as I had another hearing in Rockdale County. [1:59:54, 1:59:58]: That being said, um obviously we're extremely disappointed with the last vote. [2:00:03, 2:00:04]: And we'll continue. [2:00:04, 2:00:15]: to try and address the issues that have been raised, but we will not uh further prolong this moment. So um at this point we will simply um move on and allow the opposition to speak. Thank you. [2:00:26, 2:00:31]: Thank you, Michelle. So Mr. Tulita, we can um call for those who would like to speak in favor of the request. [2:00:32, 2:00:39]: And then after if we have any comments, I don't see any, uh we would go into those who would like to speak in opposition. [2:00:45, 2:00:48]: I I would like to go into the meeting so that we can [2:00:48, 2:00:50]: Listen to the opposition. [2:00:51, 2:00:54]: I don't I don't think we need a motion for that. Uh [2:00:55, 2:01:00]: No, we don't, we don't. I'm I'm just looking through the attendee list to see if we have any raised hands. [2:01:01, 2:01:03]: Or anything in the QA. [2:01:04, 2:01:09]: session no i do not have anyone speaking in opposition [2:01:09, 2:01:11]: Oh, in favor for this request. [2:01:12, 2:01:16]: And then we'll just if you would call for those who'd like to speak in opposition. [2:01:21, 2:01:22]: I would like to call [2:01:23, 2:01:25]: Those speaking in opposition for the uh [2:01:27, 2:01:28]: Planning your zoning. [2:01:32, 2:01:32]: Nice. [2:01:37, 2:01:43]: Again, I have no um raised hands or anything in the QA. [2:01:43, 2:01:46]: um chat for anyone who would like to speak in opposition. [2:01:47, 2:01:51]: We can close the public hearing portion at this point. [2:01:51, 2:01:52]: And uh take a boat. [2:01:56, 2:02:03]: Mr. Chairman, before the vote, may I just ask a question of Ms. Johnson, please, or any staff member. [2:02:04, 2:02:05]: Is it common? [2:02:07, 2:02:10]: Or under what circumstances or how frequent. [2:02:11, 2:02:13]: Do we change? [2:02:15, 2:02:16]: The comprehensive plan. [2:02:20, 2:02:21]: Does it uh okay. [2:02:22, 2:02:24]: Is that considered rare or is that freak? [2:02:26, 2:02:43]: In Stockbridge, based on my tenure, I would not know necessarily, but I can find out for you. Um Linda, uh Linda, can you because this is our first rezoning since I've been uh with the city, but Linda, if you can if you can give some insight, just a brief overview. [2:02:43, 2:02:45]: To answer Mr. Dumas's question. [2:02:46, 2:02:47]: Um [2:02:48, 2:02:56]: In talking with pre previously with Mr. Knighton, he's with Mr. Knighton, the city manager, he has said that different cities and counties throughout Georgia. [2:02:57, 2:02:58]: Ha um handle [2:02:58, 2:03:00]: handle this differently that some [2:03:01, 2:03:05]: Some cities and counties view comprehensive plan as being as being um [2:03:06, 2:03:09]: uh mandatory uh for approval whereas others [2:03:09, 2:03:10]: See it as being a guide. [2:03:11, 2:03:11]: Um [2:03:12, 2:03:16]: I'm not sure which position Stockbridge is is taking on that. [2:03:16, 2:03:17]: Um [2:03:18, 2:03:21]: But no, we have not had a comprehensive plan amendment. [2:03:22, 2:03:24]: Um so far in in [2:03:24, 2:03:30]: In uh two and a half years since the city has taken over planning and zoning functions from Henry County. [2:03:30, 2:03:31]: Thank you. [2:03:37, 2:03:39]: Mr. Chairman, I'm we're ready to vote. [2:03:43, 2:03:45]: Oh, we got uh well, I like [2:03:46, 2:03:50]: It looked like Mr. Coleman wanted to say something, but it looked like he is gone. [2:03:52, 2:03:52]: I'm I'm here. [2:03:54, 2:03:59]: Okay, did you wanna say anything before we proceeded? [2:03:59, 2:04:10]: Uh no, same same comments uh I had from the prior presentation, so no need to to repeat those. I just wanted Michelle Bowell to have a chance to to add any additional color. Thank you. [2:04:23, 2:04:25]: Is Mr. Terror ready for a vote? [2:04:29, 2:04:31]: I'd like to present a motion that we vote. [2:04:31, 2:04:33]: For the uh previous [2:04:33, 2:04:35]: Voting change uh [2:04:36, 2:04:38]: Recommendation to change the zoning. [2:04:41, 2:04:46]: Is there a motion on the floor? I think that would be appropriate if you call for a motion. [2:04:47, 2:04:48]: And a second and then we'll vote. [2:04:49, 2:04:51]: Okay. Well I'll call for a motion that we [2:04:52, 2:04:57]: vote on this change, uh the same recommendation that we had previous in the previous [2:04:58, 2:04:59]: Oh. [2:04:59, 2:05:02]: mi minutes, meetings that we just had. [2:05:03, 2:05:05]: Uh are there anybody in fight? I mean [2:05:06, 2:05:07]: Like is there a second? [2:05:07, 2:05:08]: I'll second that. [2:05:09, 2:05:09]: Okay. [2:05:12, 2:05:13]: All in favor? [2:05:17, 2:05:22]: What are we voting state act? What what are we voting on, denial or approval? Right. [2:05:24, 2:05:28]: Well the the motion wasn't clear. [2:05:30, 2:05:33]: No, no, no. [2:05:34, 2:05:34]: Um [2:05:35, 2:05:38]: Meaning on the property that we have, we want to change the zoning, okay? [2:05:40, 2:05:40]: No. [2:05:41, 2:05:42]: It's the same conditions. [2:05:42, 2:05:43]: On the previous [2:05:45, 2:05:49]: motion that we had pri prior to what we're doing now. [2:05:49, 2:05:50]: Now they're [2:05:50, 2:05:54]: Are are there anybody in favor that we change the zoning? [2:05:55, 2:05:56]: for this particular piece of property. [2:06:03, 2:06:07]: Uh you already voted on the zoning, now you're voting on a comprehensive plan amendment. [2:06:08, 2:06:08]: Thank you. [2:06:09, 2:06:12]: Okay. Well on the on the planning commitment I vote [2:06:12, 2:06:16]: Uh is there anybody voting for the conference planning change? [2:06:20, 2:06:24]: I if I could point out, I mean, theoretically to answer your previous question, I mean [2:06:24, 2:06:25]: Uh um [2:06:26, 2:06:29]: Land use designation could theoretically be re [2:06:29, 2:06:34]: be approved without rezoning, but that would be more speculative in nature on for benefit of [2:06:35, 2:06:37]: some other some other different [2:06:37, 2:06:43]: uh project ms mr timidale if i may um we would just need to [2:06:43, 2:06:49]: have a motion for approval or denial um formally and then the the vote [2:06:50, 2:06:53]: Mr. Chairman, uh in that regard, I move [2:06:54, 2:07:03]: On case number CP 2021-01, the dun the comprehensive plan amendment, I move that we deny it. [2:07:05, 2:07:06]: I s I second that. [2:07:09, 2:07:11]: All those in favour? [2:07:11, 2:07:12]: So yeah. [2:07:13, 2:07:14]: Hi. [2:07:16, 2:07:20]: How many was that? I'm sorry, was that Mr. Dumas, Mr. Plangent, and Miss Nelson, correct? [2:07:20, 2:07:22]: All those opposed [2:07:26, 2:07:27]: I didn't hear anybody. [2:07:27, 2:07:29]: A anybody opposed? [2:07:31, 2:07:32]: What emotion care? [2:07:34, 2:07:39]: Okay. Are you are you voting, uh, Mr. Thibodeau, or are you abstaining? [2:07:40, 2:07:43]: He's a chairperson, the only votes that they're tied. [2:07:43, 2:07:44]: Okay. [2:07:45, 2:07:47]: Great. So we have three, four. [2:07:48, 2:07:54]: And zero opposed. Let me sorry, three for denial. Three three for the for denial. Pardon me. [2:07:54, 2:07:58]: Mm-hmm. Three for denial and zero um in favor. [2:07:59, 2:08:00]: Mm-hmm. Okay. [2:08:00, 2:08:01]: Right. [2:08:03, 2:08:07]: Thank you, sir. Uh our next item, are we ready to move forward? [2:08:09, 2:08:10]: Yes, I'm ready to move forward. [2:08:11, 2:08:16]: All right, uh Linda, if you will read into the record, the next item. [2:08:19, 2:08:20]: Okay. [2:08:21, 2:08:23]: Unified Development Code UDC. [2:08:23, 2:08:28]: Um the City of Stockbridge Planning Commission and the City of Stockbridge Mayor and City Council will review. [2:08:29, 2:08:34]: Community development department's proposed new UDC, which includes the city's zoning code. [2:08:34, 2:08:36]: A new UDC would comprise. [2:08:37, 2:08:40]: Both an update and a rewriting of the existing zoning and development ordinances. [2:08:41, 2:08:43]: For the purposes purposes of one. [2:08:43, 2:08:46]: Making needed corrections and clarifications. [2:08:46, 2:08:47]: Two revising [2:08:47, 2:08:49]: Variable zoning districts in the city. [2:08:49, 2:08:52]: And three, making the document more user friendly. [2:08:55, 2:09:15]: Um, Chairman Thibodeau and uh council and board members, I'd like to um just thank you all so much for your um support and review of the UDC, our unified development code that we are proposing. Um we have the um consultants on the line um who are going to [2:09:15, 2:09:28]: and go through their review and their overview of the changes that have been proposed. You all have the document and we will go through some major changes. I've got Casey Kurzik. [2:09:29, 2:09:36]: with the collaborative firm and also Nicole Washington uh Nicolette Washington, who will be presenting this evening. [2:09:36, 2:09:43]: Um Casey, uh so Linda, if you will stop sharing and then it'll allow for um Casey Kurziv to share her screen. [2:09:44, 2:09:47]: Okay. Thank you. Great. Thank you. [2:09:51, 2:10:11]: And here we go. Thank you, Brecca. Thank you, board members, for uh staying on with us this late. So I um I know this is a large document, so I try to uh streamline it. If you recall, we actually started this entire process with this board specifically towards the end of last year. [2:10:11, 2:10:19]: And I know we've come to you a couple of times just to kind of give little updates here and there. But now we are in the home stretch. [2:10:19, 2:10:39]: and um seeking to move forward through the adoption process. So I'd like to kind of just walk you through how we got here, some of that methodology, and really just kind of breaking up the different chapters so you can really see um where a lot of the focus was spent at. [2:10:40, 2:10:42]: So here we go. [2:10:43, 2:10:55]: Um, we've kind of been through all this. I think you guys are all especially aware of this just because you deal with this on a monthly basis, unlike other boards or maybe other members of the public who might only come out. [2:10:55, 2:11:05]: when something affects them directly. But your current ordinance itself has many sections adopted between the late 90s and then, you know, just a couple years ago, about 2016. [2:11:05, 2:11:14]: Um, the organization is actually held in different chapters um in your entire code. So um you have some. [2:11:14, 2:11:34]: References in like the licensing section, in the planning section, and then you have another zoning section. Um, we also found some references that really are no longer in existence. Um they're actually referenced outside into the Henry County Code. So we did want to make sure we clean up that language for you and create it specifically. [2:11:34, 2:11:36]: Specifically for the city itself. [2:11:37, 2:11:48]: And then also we looked at all of the best practices when it came to engineering and design standards. Wanted to make sure you have the latest and greatest ones of those as well. [2:11:49, 2:12:09]: Um, like Miss Breca said, we kind of started this with some overall goals. And this is really what we heard from you all, what we heard from the elected officials, and really what we heard from the public when we went out to them. I think some of you actually joined us for those meetings as well. And that is just to improve the overall organization, update those zoning and overlay districts. [2:12:09, 2:12:17]: Works, integrate architectural and site design requirements, and define and streamline all of those review processes. [2:12:17, 2:12:26]: So, what we have is we actually have a new UDC organization. So instead of having to go through different [2:12:26, 2:12:46]: Whether it be chapter five, chapter eight, or chapter 12, I believe it's where the other one is, you will now go to uh the chapter 12 and you will find all of your zoning provisions, all of your sign standards, all of your tree protection standards, how to subdivide land, environmental protection standards. [2:12:46, 2:12:50]: standards and then also your infrastructure improvement of your streets. [2:12:51, 2:13:01]: So if it's okay, we'll just jump right in to the zoning districts. Um, because what we really did is uh we really went through and really navigated through your text. [2:13:01, 2:13:21]: Through your current zoning map. And we also matched everything back to your comprehensive plan. That's the future development map that you were all just talking about at the item before. Um, and we really just kind of looked at the districts and we just noticed something. So you have the little table to the right. Um, many of your residential districts. [2:13:21, 2:13:38]: just really aren't being used. And really, you know, that's not a bad thing. I think some of them actually came over from Henry County. But you know, as the as your sewer began to expand and as development tend to occur, you know, you're just not building those larger lots anymore. [2:13:38, 2:13:58]: So we're looking at the RA and the R1, which are kind of your single-family residential, defining requiring an acre or more. Those are really your least used. And then you actually have your duplex, which really only has a couple more development areas in it. And then most of your multifamily. [2:13:58, 2:14:15]: Family is actually held within that RM, that multifamily disc district. We couldn't actually find any apartments on the map. That's your RM1. You do have some of the property zoned for townhouses and very little for the condominium section. [2:14:15, 2:14:35]: And then going through when we look at the commercial districts, those are kind of normal actually. Those are really kind of how most jurisdictions spell them out, making sure there's a difference between your office institutional, making sure that your neighborhood commercial would be able to locate well inside or near residential. [2:14:35, 2:14:42]: And then of course your C2s and your C threes, more on those major corridors and by your interstate changes. [2:14:42, 2:15:02]: And then looking down at your heavy manufacturing is kind of lower there than you can see your light. And then one of the things we did find is that the majority of your single family residential is actually zoned for your PD, which is your planned development. However, a couple of years ago, [2:15:02, 2:15:04]: That was actually removed from the code. [2:15:04, 2:15:10]: However, a lot of your properties are still holding that zoning designation on the map. [2:15:10, 2:15:15]: So that's one of the things that we kind of look through to kind of set up the methodology. [2:15:15, 2:15:31]: So when we really kind of dove in after we went through all the public and kind of listened to everything and met with the different boards and commissions, what we are proposing is that some of these underutilized districts actually be combined. [2:15:31, 2:15:37]: Or actually expanded. There are several districts where we actually expanded the uses. [2:15:37, 2:15:53]: So looking like once again for those the residential agriculture on the single family, merging those into the rural residential, you do still have some properties, primarily in the northwestern corner of the city that still have that style of development. [2:15:55, 2:15:57]: Merging together your R2s and your R3s. [2:15:58, 2:16:10]: Um, the one thing we did is actually expand a lot of the uses in your duplex zoning, um, which we're now calling the city center residential. And we'll actually go into that just a little bit further down. [2:16:11, 2:16:30]: Um, looking at combining all of your multifamily back into one district with specific requirements. And then we did actually create a new district, and that is specifically for your downtown area. That is actually primarily one of the comments we received out of the public comments. [2:16:30, 2:16:50]: And then merging some of your heavy industrial with your railroad uses. And then if you remember, you have a lot of properties zoned that PUD. So what we did is we actually um drafted a new PUD ordinance for you. So not only would it allow residential, but it will also allow some commercial. [2:16:50, 2:16:57]: Commercial uses in there. And it would be mixed use either across the land or in the buildings vertically. We'll go into that a little more. [2:16:58, 2:17:11]: So what you have before is 19 previous zoning districts. And with kind of that reorganization and some of those expanded uses, you would be down to 13 districts overall. [2:17:12, 2:17:32]: One of the things that we also noticed is when it comes to your districts itself, actually none of them reference what actual residential uses are allowed in all residential zoning districts. So we really wanted to make sure that we put the focus back on to making sure that there [2:17:32, 2:17:51]: is an intent for each district, making sure that the permitted uses are clear, making sure that the conditional uses are clear. And then also going into the actual design standards. So your minimum lot requirements, your front, your sides, your rear setbacks, and your heights. [2:17:51, 2:18:00]: And we've actually created them in kind of a new two-page layout for everyone so they can actually see it as that district exists. [2:18:01, 2:18:07]: Another item that you'll have in the code is a uh land use table or a a [2:18:08, 2:18:28]: a uh district use table or matrix, some people call it, but this will be a catch-all for staff and anyone from the outside, whether it be a developer or an architect or even just you know a property owner to really kind of see what uses are allowed in each zoning district. I know uh [2:18:28, 2:18:48]: Ms. Brucca and all her staff can tell you, they field phone calls every day, all day long, I'm sure. And people either have the zoning and they know where their property is and they want to know what uses they can build on it, or they know what their business is and they want to know what property they have to go find. So either way, um, staff will be able to answer. [2:18:48, 2:18:50]: those questions quickly for them. [2:18:51, 2:19:11]: Now going back to some of those expanded districts that we talked about earlier, um, this new city center residential district allows for additional housing types. And these are kind of, I think the term is out there, we've all kind of heard it before, but these are kind of those missing middle housing opportunities. So it's not [2:19:11, 2:19:31]: quite single family but it's also not quite the density of true you know mixed use or high-rise apartment complex or anything like that so those uses would be duplexes triplexes quadruplexes um offering accessory dwellings that may be something where there'd be like an in-law suite [2:19:30, 2:19:44]: maybe in a garage type setting or maybe built into the house themselves. And then also making sure that there are senior housing choices that can be conveniently. [2:19:44, 2:19:50]: um placed in these districts, um preferably um more down to the [2:19:50, 2:19:59]: near the city center, like the downtown area where your new amphitheater are, maybe closer to some major corridors. So there can actually be more offerings and [2:20:00, 2:20:02]: uh availability for people [2:20:04, 2:20:24]: Um, and then once again, we kind of want to go back to that mixed use, that PD district that we um kind of recreated. We merged a little bit between your PTD and your M U N D. And then we actually allowed more uses. So allowing those combinations of uses, which is gonna promote flexibility in those. [2:20:24, 2:20:41]: development standards and actually creating a little bit of a different process so a developer could come in and make sure that you see exactly what he's proposing before anything is even rezoned. [2:20:41, 2:20:53]: So what that new process would require that the preliminary concept be reviewed by yourself as the board and then once again by the city council. And then if that concept plan is approved. [2:20:54, 2:20:56]: And they may have. [2:20:56, 2:21:16]: um a mixture of single family housing with townhouses, with maybe some uh commercial or even some mixed use process. And then they would actually go into their full master development plan, which would be the fully engineered documents of how it would be designed and approved. And those approvals [2:21:16, 2:21:18]: would go through the city reviewers themselves. [2:21:20, 2:21:40]: Um, another thing, which I know we're going to talk on the end, we kind of have two public meetings here tonight. Um, but when we look at updating the text and modifying some of those zoning categories, we also have to make sure that the zoning map is um consistent and has all of those language on there. So you can see that's the map right. [2:21:40, 2:21:41]: right there as we're proposing it. [2:21:43, 2:22:03]: And then the same thing we talked about creating that new downtown Main Street district. Once again, we created the same layout so everyone would know what's available. When it comes to the residential uses, the idea is really to get them more on the upper floors of that downtown area and then make sure that your retail options are things. [2:22:03, 2:22:23]: Things like your apparel stores, your retail stores, your bakeries, pharmacies, professional offices, restaurants, outdoor dining would be allowed, things of that nature. And then we did actually build in some conditional uses. Once again, some diversity in housing, those duplexes, triplexes, and quadruplexes. [2:22:23, 2:22:34]: And then making sure that we kept those conditional uses that are already set forth within your code, which are the bars, the taverns, and the billiards and the arcades. [2:22:35, 2:22:43]: Casey, if you don't mind if I'll jump in for just a moment. Um, I wanted to kind of point out to the count the planning commission tonight that [2:22:44, 2:22:52]: The downtown Main Street District has been a conversation, I think, for quite some time. Now that we have the amphitheater in place. [2:22:52, 2:22:56]: These standards were built around that reality. [2:22:56, 2:23:02]: to ensure that we allow for uses that are gonna be compatible, attractive. [2:23:02, 2:23:06]: For folks who are going to be utilizing the amphitheater. So I wanted to point that out and [2:23:07, 2:23:15]: Um, because there's a lot of thought has gone into this um project. Uh, we've been working specifically with economic development. [2:23:16, 2:23:20]: on this particular district to come up with something that makes sense. [2:23:20, 2:23:29]: that is in line with their Main Street plan, is in line with what they like to see kind of build and be a catalyst type development. [2:23:30, 2:23:34]: in the downtown area. So uh just want to keep that in mind and keep you um [2:23:34, 2:23:37]: Keep that in front of you as you continue your review. [2:23:37, 2:23:39]: Perfect. Thank you so much. [2:23:40, 2:23:45]: And then do we kind of pulled an excerpt out here and put the um [2:23:46, 2:23:50]: kind of map overlay on the bottom so you can see that, but this will be the parcels. [2:23:51, 2:23:53]: That are actually [2:23:53, 2:23:56]: Um, going to hold that new downtown zoning district. [2:23:57, 2:24:17]: um classification. So I think you can kind of see because I know that just a regular parcel map wouldn't have done you any justice, but this is actually where the new amphitheater is in City Hall. So it's just an older photo that we found online, just so you could get your bearings and then this is your entrance into downtown and up through the the park area. [2:24:17, 2:24:17]: Yeah. [2:24:21, 2:24:41]: And um we still kept that um there was actually an overlay um through the downtown area. So we didn't actually change all of the properties to that downtown area, really focusing more on that kind of core of the downtown and then expanding outward, especially onto properties that the [2:24:41, 2:25:01]: city owns because that's a great opportunity to really get those catalyst sites off the ground and build on the idea of what the economic development team and of course your community development team is working towards right now. So we kept those same things outdoor dining and special events, making sure you still have the architectural features, the permitted material [2:25:01, 2:25:05]: materials and colors and the streetscapes and the parking requirements. [2:25:07, 2:25:27]: Um, and then one new thing that we did, which we kind of heard, and it was kind of, I think, kind of stimulated a little bit um by a lot of the JOTICO development. We went back and we really looked at your overlay districts. You had three of them, whether you knew it or not, you do. Um that's the high. [2:25:27, 2:25:33]: High rise district, the highway 138 corridor, and then the highway um [2:25:34, 2:25:37]: Course, the photos are all on it, the highway corridor. [2:25:37, 2:25:45]: Um, had to move that around. And what we saw, and even what staff told us, is there's areas where there's properties that actually fall into. [2:25:47, 2:26:07]: Two, if not some actually fall into all three of those districts. So at that time it's really kind of hard to determine for staff and for you know an engineer or developer, like which overlay is going to supersede. So what we really did is look at where your future development map calls that growth, what [2:26:07, 2:26:27]: What each district was meant to do. So, like your high-rise was actually to promote mixed use, to get that higher density, to get that commercial on the bottom floor, the residential, maybe even office on the upper floor. And then your highway corridor and your 138 were really a lot about your architectural details, about your [2:26:26, 2:26:40]: streetscapes and things like that. So what we did is we actually combined a lot of the standards and we created one district itself that will be called the Parkway Mixed Use Overlay District. [2:26:41, 2:26:58]: And that will allow mixed use development by right. They won't have to come in for a conditional use or any special approval. It will allow some increased heights compared to other areas of the city. And that's because these areas are really more focused towards the interstate and the major corridors. [2:26:58, 2:27:11]: Uh we did write in the allowance of some reduction in parking. So when you do have more of those mixed use on the property, the goal would be that the parking would be shared throughout the entire day and night and managed in a little different way. [2:27:11, 2:27:21]: Making sure that we include those site design and access standards, and then also make sure that the landscaping lighting and buffer requirements are all still in there. [2:27:21, 2:27:27]: Um and you can kind of see them here, these are actually the two different overlays, just kind of the map showing you where they are. [2:27:30, 2:27:37]: And then the other thing we actually jump in one more one more thing case. My apologies. If you go back to the the previous map. So [2:27:37, 2:27:39]: The parkway makes use overlay. [2:27:40, 2:27:46]: A district is and you can see if you look just kinda to the northwest. [2:27:46, 2:27:48]: You'll see the parcel. [2:27:51, 2:28:11]: That was for pre-distoning is considered a parkway mixed use overlay. The attempt for that property and other properties, if you for the far south, which is bridges at Jodico, are designated for those mixed use, mid-rise, high-rise types of development, which have um uh compatible uses. [2:28:10, 2:28:15]: in the general vicinity and within walking distance or a short, short drive. [2:28:16, 2:28:18]: And I just want to point that out to you because [2:28:19, 2:28:21]: currently bridges of Jotaco is being [2:28:22, 2:28:25]: Going through the process to become a built out. [2:28:25, 2:28:28]: project and we've been talking about it for years now. [2:28:28, 2:28:36]: Give a short, short update once we finish. But this is, we wanted to condense and make sense of. [2:28:37, 2:28:48]: the types of um standards, development standards we had for these. And what we did was take on the Jodico South Design Guidelines, which is this South parcel. [2:28:48, 2:28:53]: Just um that's being going through the process of being developed now because we saw [2:28:54, 2:29:04]: that a lot of these overlays had some variation of that particular those guidelines. So we wanted to kind of mirror those and stay with the [2:29:04, 2:29:06]: The same flavor and character. [2:29:06, 2:29:09]: of the area we're trying to to create. [2:29:09, 2:29:18]: and and look at trends throughout you know nationally and look at opportunities for for growth and for new projects. [2:29:19, 2:29:21]: Oh thanks, Casey. Perfect, no problem. [2:29:23, 2:29:43]: Um another thing that we really um I say created, and that's just because there really weren't any true citywide development standards. So what we did is we actually re we actually created real development standards. So those are gonna be your architectural requirements for your mixed use, your commercial. [2:29:43, 2:30:03]: your residential guidelines. And once again, these were all based upon those Jodico design standards, which I know were drafted a couple of years ago when that was came through. But we really took the ideas there in requiring the open space, in requiring outdoor lighting standards. [2:30:02, 2:30:22]: In requiring streetscape requirements, in requiring um bike paths. And then one of the things would be adding for all the major highways to have a 10-feet wide pedestrian travel zone and a 10-feet wide fixture planning zone. So that's really going to start um bringing the [2:30:22, 2:30:25]: The focus also to the streetscape. [2:30:26, 2:30:46]: Um, so um not just the landscaping, but also hardscape that's built in the there, like the lightings and um possibly trash receptacles or even park benches and things like that to really kind of get an eye and a focus now as you're really driving through these corridors so you can know that you're really in the city of Stockbridge because [2:30:46, 2:30:52]: because the building architecture should start looking the same and the roadways should start looking the same. So all of that type of information. [2:30:54, 2:30:57]: Uh may I may I have something pertaining to that? [2:30:57, 2:30:58]: Shit? [2:30:58, 2:31:02]: You said you took a lot of this information from the Jodeco station. [2:31:03, 2:31:03]: This project. [2:31:04, 2:31:05]: Am I correct? [2:31:05, 2:31:06]: That's correct. Mm-hmm. [2:31:07, 2:31:11]: And the planning zoning uh actually developed that. [2:31:11, 2:31:13]: project for [2:31:13, 2:31:15]: that particular community. [2:31:15, 2:31:17]: That's correct. Absolutely. Mm-hmm. [2:31:23, 2:31:43]: Um, so that's kind of where we are with really a lot of the true zoning items. So now we're gonna kind of move into the signage. Um, the signage really uh we really just had some minor changes in there from what staff identified that were kind of problematic or just needed to be updated. Um, but I want to make sure you know you're still going to have all of your monument-based signs. [2:31:43, 2:31:43]: Thanks. [2:31:44, 2:31:50]: Um you will still have the limited wall signage that's based upon the square feet of the front of the building. [2:31:51, 2:32:01]: You'll also have requirements to have a landscaping kind of planting around the sign bases and then making sure that the temporary signs are regulated accordingly. [2:32:02, 2:32:08]: Um now another thing, this is where kind of where we get into the crux of really where a lot was. [2:32:09, 2:32:10]: Really just written new. [2:32:10, 2:32:11]: Um [2:32:12, 2:32:32]: Or not yet, I guess we're still going through the zoning process here. But the one thing we did is we have to look at the processes. And you guys are part of that process. So those rezoning processes through those conditional use permits, the comprehensive plan amendments, text amendments and variances. Um, these were really just all altered and kind of updated. [2:32:32, 2:32:36]: just to create consistency through the way they were just written. [2:32:36, 2:32:45]: Um, so no one none of your processes were completely overhauled. Just kind of tweak to streamline them a bit a little bit and make sure all of the texts read correctly. [2:32:48, 2:33:08]: Um, when we looked at the tree protection ordinance, um, this was actually one that was truly rewritten just to ensure compliance with the true industry standards. Um, previously, I think it was Linda may have been the only person who really knew where these standards were and that there was a paper copy located in the clerk's office. So what we're [2:33:08, 2:33:28]: Really did is truly incorporate them into the code themselves and make sure that we have all the requirements in there for the tree survey, making sure that development protects the trees. More importantly, that the trees that they identify to be protected will actually be um have the proper. [2:33:28, 2:33:48]: Proper fencing around them, have the proper diameter saved around them, so they will continue to grow for years to come. Also making sure that there's a tree density requirement. So you wouldn't just be able to clear-cut the land, you would actually have trees that remain or could be replanted depending on the land. [2:33:47, 2:33:54]: depending on what the sites need, and then making sure that there's the true final inspection process built in through the city there. [2:33:55, 2:34:07]: Um, the subdivision regulations, um, this process wasn't really clearly defined before. So we really went ahead and solidified it, made sure that there's the process for the preliminary plat. [2:34:08, 2:34:27]: For the like a smaller subdivision, maybe you're just dividing a ladder to the official final plat recording and the official recording at the clerk's office. And this is all actually processes that community development does, but we really just wanted to spell it out for them clean and easy so everyone could read. [2:34:29, 2:34:49]: The environmental protection sections were actually completely updated to ensure compliance with the federal and the state regulations. So these really get into true, true engineering design and true EPD regulations and everything that the city has to do with the state on an annual basis. [2:34:49, 2:35:04]: So that's going to be your soil erosion and sedimentation control measures, your floodplains, your stream buffer protections, stormwater management, and then the discharge of any illicit substances or water or anything like that. [2:35:06, 2:35:26]: And then once again, the infrastructure improvements, these are kind of really going to go back to your streets and your pedestrian access. Um, these were actually just referenced in the Henry County Code. Um, and since you're referencing in the code, Henry County has actually rewritten them twice that we have found. So we really [2:35:26, 2:35:46]: Really went ahead and made sure that you had your own set of standards. A lot of it does mirror Henry County just because there's a lot of shared access points. But making sure that you can collect the traffic impact studies, the access requirements, that true design and construction of the roadways, the visibility at the intersection. [2:35:46, 2:35:56]: section. Once again, pedestrian access, street names, street lights, all of that is now going to be truly incorporated in the city code. [2:35:57, 2:36:17]: And then when it comes to other updates, these are really kind of what I just kind of call housekeeping items. You had several references to like a municipal planning commission and a county planning commission. So we really made sure that you only had the one reference. And then previously the board must have been called the Planning Advisory Board, Zoning Advisory Board. [2:36:17, 2:36:30]: advisory board, something like that, we found some language that just needed to be removed. And then of course we updated your definition sections based upon the changes that were made in the code itself. [2:36:31, 2:36:51]: Um, so through this process here, we are we are really right here in that public hearing process. Um, but the document is is not final. That's one of the reasons that we're here tonight to actually seek any final comment that you all may have as the board or that the residents may have. Um so we will update those. [2:36:51, 2:37:03]: accordingly, get it back to the city to review. We're kind of in that first public hearing process right now, and then it'll move forward through that city council adoption process next month. [2:37:06, 2:37:09]: So that's kind of it here on the zoning code. [2:37:10, 2:37:11]: I know we have the map next. [2:37:19, 2:37:21]: Yes, I'll read that record. [2:37:22, 2:37:32]: Um official zoning map. We're we're not we're not ready. We're not ready yet, Linda. We need to to handle the public hearing for the uh UDC. Um Mr. Thibodeau. [2:37:32, 2:37:40]: Um if you would, if there is any um discussion by the Planning Commission, any questions, we can move into that and then [2:37:41, 2:37:45]: I will handle it just as we did for the previous rezoning and comp plan. [2:37:46, 2:37:46]: Amendment. [2:37:47, 2:37:50]: uh for public comment for those who want to speak. [2:37:50, 2:37:51]: For [2:37:51, 2:37:52]: Or against. [2:37:53, 2:37:55]: Commission is here. Com comments. [2:37:56, 2:37:58]: Permission to speak, Mr. Thibodeau, this is Kathleen Nelson. [2:37:59, 2:38:01]: Yes, Mr. Nelson, go ahead. [2:38:01, 2:38:07]: Uh and I just wanted to clarify um when we had our little breakout session. [2:38:08, 2:38:10]: If someone [2:38:10, 2:38:19]: um you know has already been established once you put this plan in place, they'll just be grandfathered in or will will certain areas be required to make changes? [2:38:20, 2:38:40]: Um, sure. So there are transition rules. So if a property is fully developed and they're not coming into the city for any type of permitting, or let's just say they recently rent through their land development process or maybe a rezoning process, they will continue on their original path as they were approved to get that full. [2:38:40, 2:39:00]: Construction. So in this case, the new codes and the new requirements when come into effect when you have new rezoning cases, when the staff actually sees, let's just say, new building permits or new land development permits that just weren't in the process before. But we did build in that anything that's [2:39:00, 2:39:03]: the process now would still just follow the current zoning. [2:39:03, 2:39:07]: um code until it's actually um completed construction. [2:39:10, 2:39:14]: Mr Chibado, Mr Chairman, may I please? [2:39:15, 2:39:16]: Yes, go ahead. [2:39:16, 2:39:31]: question um in those instances well first of all thank you this is very i'm excited about this this is very detailed very thorough and i think it's gonna be a great benefit for the city and the people that wishes to do business with the city [2:39:32, 2:39:37]: But I wanna ask in in those cases where you consolidated certain codes. [2:39:40, 2:39:43]: Well,'cause I'm concerned how that's gonna look on the map. [2:39:43, 2:39:45]: Those those that would disappear. [2:39:46, 2:39:48]: Will they have to go before zoning? [2:39:49, 2:39:52]: change or would that once was the city? [2:39:52, 2:39:57]: The city council approved this, they will automatically migrate to the new [2:39:59, 2:40:02]: Sure. Without having to go through a zoning here. [2:40:02, 2:40:22]: Well, that's correct. That's why you actually have two items on the agenda for this tonight. So the one, the first one is actually the zoning text. So that is all of it written out. And then the second one is actually the zoning map. So what we did is we actually went in and already re-identified all of those parcels of land to [2:40:22, 2:40:27]: to the proper zoning. So when you adapt both of them together, then they match. [2:40:28, 2:40:39]: So the the owner of the property won't have to do anything. The owner of the property won't have to do anything. Won't have to do anything. Very good. Next question. Uh and this is probably more directed to Ms. Johnson. [2:40:40, 2:40:45]: Um because I'm aware that in certain situations there have been [2:40:46, 2:40:59]: uh subdivisions for example that's been uh permitted to build single family residential homes and at some point along the way [2:41:00, 2:41:02]: They all became rentals. [2:41:03, 2:41:23]: And and and I'm just curious, is is is zoning code a proper mechanism to because I didn't hear anything or have seen anything that addressed that issue. I I wonder if the zoning code is is a proper mechanism to to address that issue. [2:41:23, 2:41:30]: Uh the uh the maybe the city has other mechanisms in place already or developing. But I I'm just curious to hear. [2:41:31, 2:41:33]: how that fits into what we're doing with the UDC. [2:41:34, 2:41:37]: Great, great question, Mr. Damas. So [2:41:37, 2:41:48]: This is a conversation actually that Casey and I have kind of gone back and forth on. And we just decided we're going to, you know, take it to our attorneys to determine what we can do because [2:41:48, 2:41:52]: if we do put uh just kind of give background for everybody. [2:41:53, 2:42:02]: There has been a moratorium which is currently in place for single family homes to be built as for rental purpose. [2:42:03, 2:42:05]: you know, subdivisions. [2:42:05, 2:42:08]: And one of the things that we ran into. [2:42:08, 2:42:14]: um as far as making this a code is we don't want to violate the Fair Housing Act. [2:42:15, 2:42:23]: So that is really our benchmark, our our standard to ensure that we're not encroaching upon a federal uh [2:42:23, 2:42:24]: federal standard. [2:42:25, 2:42:28]: So we well what we what we can and will do. [2:42:29, 2:42:36]: is um I'll bring this specifically, Casey and I'll bring this specifically to our attorneys to address how we can [2:42:36, 2:42:38]: Manage it um [2:42:39, 2:42:43]: Because there's there's a couple of schools of thought regarding it. [2:42:43, 2:42:44]: And um [2:42:45, 2:42:49]: At the end of the day, I think on the from the city's perspective, from the staff perspective. [2:42:49, 2:42:53]: We want the properties to be kept up and well maintained. [2:42:54, 2:42:59]: however they're being utilized as long as they meet the zoning. But we will again [2:42:59, 2:43:07]: Make sure that we're not, you know, if we can put some stipulation in the code regarding this. And this is not just a stock bridge concern. [2:43:07, 2:43:10]: So I think it's very astute of you to bring this up because it is [2:43:10, 2:43:17]: really been around Henry jurisdictions and really a national it's a national conversation. [2:43:17, 2:43:19]: So um because a lot of [2:43:20, 2:43:25]: Um several home builders are shifting to this model because they have a market for this model. [2:43:26, 2:43:33]: So um we will continue to have those conversations with the attorneys. And also we're have we have conversations with our building community. [2:43:34, 2:43:36]: Because they ultimately are gonna be affected. [2:43:37, 2:43:39]: one way or another by these standards. [2:43:39, 2:43:43]: And we do want to hear we do want to hear from them on some thoughts. [2:43:43, 2:43:46]: And concerns that they have too, but in this particular case. [2:43:47, 2:43:52]: we would have to just make sure that we're not violating a federal mandate, a federal standard. [2:43:53, 2:43:58]: So I definitely can get this back to the attorneys and follow up with you and the and the board. [2:43:58, 2:44:00]: Regarding that item. [2:44:02, 2:44:02]: Thank you. [2:44:03, 2:44:04]: Absolutely. [2:44:16, 2:44:20]: Mr. Thibodeau, any other comments from the from the Planning Commission? [2:44:21, 2:44:24]: No, I'm just absorbing it all in. Just uh [2:44:25, 2:44:29]: really listened to a lot of it's coming from the development when we were [2:44:30, 2:44:33]: doing the Jodico project, but I'm also happy that uh [2:44:34, 2:44:40]: We're bringing things together where it would be easily processed and looked at and whether or not it meets the [2:44:41, 2:44:46]: zoning or not, which is real good. I I think we're moving up to the twenty first century. [2:44:46, 2:44:47]: Yeah. [2:44:48, 2:44:49]: Thank you for that. [2:44:50, 2:44:53]: Okay. [2:45:00, 2:45:03]: Well, Miss Johnson, this item requires a vote. Am I correct? [2:45:03, 2:45:08]: Yes, sir. It does. However, we do need to open it up for public comment. [2:45:08, 2:45:10]: Афосуально. [2:45:11, 2:45:14]: And those who are in opposition, and I'm looking through. [2:45:15, 2:45:18]: Um I am so we would just need to have a [2:45:18, 2:45:19]: Um [2:45:20, 2:45:23]: Uh I open up the public hearing for those who are in favor. [2:45:24, 2:45:30]: And then I'll I'm checking to see if we have anybody with a hand raised or a question in the chat. [2:45:32, 2:45:35]: I think we should go ahead and open it up to the public meeting and uh [2:45:36, 2:45:37]: Go ahead and install it. [2:45:38, 2:45:38]: I don't know. [2:45:38, 2:45:40]: See what they think about it. [2:45:41, 2:45:41]: Okay. [2:45:46, 2:45:50]: I do not see anyone who has a raised hand. [2:45:50, 2:45:55]: Um for this section, this portion. So we at this point do not have. [2:45:55, 2:46:03]: Anyone to speak in favor of the request? And we can open it up for those who want to speak in opposition. [2:46:10, 2:46:14]: should go ahead and open it up if we have anybody that's in opposition of it. [2:46:17, 2:46:18]: We do not. [2:46:21, 2:46:23]: So I think we're ready for call to call for motion, sir. [2:46:26, 2:46:29]: Okay, I'd like to present a motion that we [2:46:30, 2:46:31]: Make the new changes for the [2:46:32, 2:46:33]: zoning and planning. [2:46:33, 2:46:35]: Doctors do changing. [2:46:35, 2:46:36]: Changes that we [2:46:37, 2:46:39]: to more streamline the uh [2:46:39, 2:46:41]: Process for zoning and planning. [2:46:44, 2:46:55]: I will second that. Mrs. Mr Mr. Chairman, um, if if you don't mind, I think your motion probably should have some wording in it about [2:46:57, 2:46:58]: The unified development code. [2:47:01, 2:47:02]: Because that's what we're voting on. [2:47:03, 2:47:05]: I'd like to present that. [2:47:05, 2:47:06]: A unified [2:47:07, 2:47:08]: Planning code. [2:47:09, 2:47:10]: Combining it. [2:47:10, 2:47:12]: And making it streamlined to easy. [2:47:13, 2:47:14]: access and understand. [2:47:16, 2:47:18]: That that would be my motion, present it. [2:47:18, 2:47:19]: Is there a second? [2:47:24, 2:47:28]: Mr. Plashon has seconded. I was just asking you to correct the verbiage. [2:47:30, 2:47:31]: I did. [2:47:32, 2:47:33]: Well, we're ready to vote. [2:47:34, 2:47:36]: Yes. All in favor? [2:47:36, 2:47:37]: Say aye. [2:47:37, 2:47:38]: Hi. [2:47:38, 2:47:38]: Bye. [2:47:39, 2:47:41]: Arnold Old opposed. [2:47:43, 2:47:44]: There's none opposed. [2:47:45, 2:47:45]: And [2:47:45, 2:47:47]: Of eyes carried. [2:47:49, 2:47:51]: Awesome. Thank you very much. [2:47:52, 2:47:58]: All right, if we're move if we're ready to move to the next item. Um Linda, if you'll read the next item into the record. [2:48:01, 2:48:01]: Yes. [2:48:02, 2:48:03]: Official zoning map. [2:48:03, 2:48:07]: City of Startbridge Planning Commission and the City of Startridge Mayor and City Council. [2:48:08, 2:48:09]: We'll review the proposed [2:48:09, 2:48:12]: Official zoning map to be amended. [2:48:12, 2:48:15]: In conjunction with the unified development code UDC. [2:48:15, 2:48:20]: Which includes the city zoning ordinance. This item will run concurrently with the UDC. [2:48:23, 2:48:33]: Thank you. So once again, you just uh thank you because you just recommended approval of our text. And so now we have the zone map. [2:48:33, 2:48:53]: Um, so I know Miss Bruca and her team are working on really creating a digital zoning map. So I'll give you kind of a little geeky, nerdy background to this. Um this all lives in a digital world. Um, but for purposes here today and of course making it easier to understand. [2:48:53, 2:49:13]: We kind of pulled all of those different elements out for you all tonight. But I do believe in the short near future, you will be able to log online and play with it yourself, typing in the addresses, and you will actually stumble across these different layers. So this one right here is the true zoning map with all of the new districts that we discussed. [2:49:13, 2:49:33]: Keeping your residential colors more of that orange to the or the yellow to kind of that orange-ish brown tone, moving into those commercial corridors, which are going to be your pinks through your reds, your office institutional is going to be the lighter view, that new downtown development district. [2:49:33, 2:49:44]: is kind of the, I guess it's a little bit of a darker blue. Your industrial Dixtrix will have that purple hone and then the PUD will kind of have that teal color. [2:49:44, 2:50:04]: Um, and then just you saw it once before, but what also goes hand in hand on those digital files when you would click on it in the future would be whether the property does or does not fall in an overlay district. So in this one, you can see the parkway mixed use. That's more of the pink tones following the interstate, and then that downtown village overlay. [2:50:04, 2:50:10]: relay is really where your city center is, where the city hall, the amphitheater, and the downtown area are. [2:50:13, 2:50:15]: You probably want to see that one a little more. [2:50:19, 2:50:20]: Awesome. [2:50:20, 2:50:24]: Thank you, Casey, and so Mr. Tibetou. Um we again [2:50:25, 2:50:25]: [10225.6, 10226.1]: Mm-hmm. [2:50:27, 2:50:30]: You got it. Opening up for um [2:50:31, 2:50:33]: for public comment, uh as it is a public hearing. [2:50:34, 2:50:36]: Uh, for folks who are in [2:50:37, 2:50:39]: Um in favor of the request. [2:50:41, 2:50:43]: I'd like to open it up for public. [2:50:43, 2:50:44]: Uh [2:50:45, 2:50:46]: Concerns. [2:50:50, 2:50:52]: Do we have anybody that [2:50:52, 2:50:56]: Yes, or we do not we do not have anyone who is [2:50:56, 2:51:00]: looking to speak in favor of this request, um, we would need to [2:51:00, 2:51:03]: Open up public hearing for those who are in opposition. [2:51:03, 2:51:05]: I'd like to open up for those. [2:51:05, 2:51:07]: Uh, who are here in opposition. [2:51:07, 2:51:08]: Public. [2:51:10, 2:51:10]: Do we have any? [2:51:12, 2:51:13]: We do not. [2:51:16, 2:51:20]: All right, I think we're ready to close the public hearing portion. [2:51:20, 2:51:23]: And um make a motion. [2:51:26, 2:51:29]: Unless there is further discussion by the council, of course. [2:51:30, 2:51:34]: Now this is not an item we vote no. This is just presentation, right? [2:51:35, 2:51:40]: This is an item that we would vote on. Um it goes hand in hand with the what was [2:51:40, 2:51:52]: kind of shown to you as far as the new zoning districts, allowing the new uses throughout the city. So this is just a formality of the UDC that you already approved. [2:51:53, 2:51:54]: Okay. [2:51:54, 2:51:58]: Then I I guess the next move motion would be that we'll join the meeting. [2:52:00, 2:52:03]: Well we still need you still need a motion to approve the [2:52:03, 2:52:09]: Oh yes, that's what I was asking. Yes, yes, yes, yes, you're correct. Oh okay. [2:52:09, 2:52:13]: Then I I would like to present a motion that we [2:52:13, 2:52:15]: Uh approve this what is it? You [2:52:16, 2:52:16]: Uh [2:52:17, 2:52:18]: The official zoning map. [2:52:18, 2:52:21]: Yeah, the official zoning map for the city of Stockbridge. [2:52:23, 2:52:23]: Oh. [2:52:24, 2:52:25]: Do I have a second? [2:52:26, 2:52:27]: I second that. [2:52:32, 2:52:33]: All in favor? [2:52:35, 2:52:37]: Hey. Hi. [2:52:39, 2:52:41]: All those opposed? [2:52:42, 2:52:43]: Yeah, I just have it. [2:52:45, 2:52:46]: The motion passed. [2:52:47, 2:52:48]: Thank you very much. [2:52:49, 2:52:49]: Wonderful. [2:52:51, 2:53:01]: Awesome. Thank you, Chairman. Thank you, uh, Planning Commission members. Um the the next the thank you because you you guys have have worked really hard and I I have to give a [2:53:02, 2:53:08]: Super, super, duper kudos to um my team for really taking the time going line by line. [2:53:08, 2:53:12]: through this document with the consultants to make sure that we are [2:53:13, 2:53:16]: In compliance on the state and federal sides. [2:53:16, 2:53:30]: Um, and making sure that we are opening up our our borders in a reasonable way, which still has the standards that we hold dear, like JoeDo design guidelines and creating an opportunity for downtown development. [2:53:31, 2:53:47]: Um, that is comparable to other downtowns in the Metro Atlanta area. So thank you so very much. Um, I wanted to just give a couple quick quick updates while you guys still have some bandwidth for me. Um, so um the Bridges and Jodico project, which you saw was at the south end. [2:53:47, 2:54:02]: of the zoning map. Again, and thank you, Casey and Nicole, for um getting all this together for us. And we'll be talking with you guys probably tomorrow morning to kind of wrap up any updates or changes. Wonderful job team. [2:54:02, 2:54:09]: So um the Bridges of Jodico project is um about a hundred and forty two or so acres. [2:54:10, 2:54:13]: There is a uh fifteen or so acre property. [2:54:13, 2:54:33]: That a consultant is coming in and a builder is coming in and building about 306 multifamily units with mixed use on the bottom level. It really has a really cool contemporary feel, but has those wide sidewalks, street trees, street uh lamps. [2:54:33, 2:54:34]: Okay. [2:54:34, 2:54:41]: and provides as a catalyst site or catalyst project for bridges at Joe Dakota continue building out. [2:54:42, 2:54:54]: I want to keep you all abreast of that. They've submitted for their land disturbance permit and their building permits. So we are on the final review for their land disturbance permit and hope to issue those within the next week or so. [2:54:54, 2:54:59]: and then we'll be doing our final review on the actual building materials themselves. [2:55:00, 2:55:03]: Next, the amphitheater, as you all know, our first um [2:55:04, 2:55:17]: a formal uh concert will be this Saturday, which will be Miss Gladys Knight and Miss Patty Fabel. Um it was sold out literally, I think in two or three hours when it was put out online. [2:55:17, 2:55:20]: Um, but it's going to be an interesting um night. [2:55:21, 2:55:25]: And I believe it's gonna be televised. So please keep your eye out for that. [2:55:25, 2:55:26]: Um [2:55:27, 2:55:28]: In late October [2:55:29, 2:55:31]: Uh as you were looking at the zoning map. [2:55:32, 2:55:37]: And you and you see where the city of Stockbridge city limits are versus Henry County. [2:55:37, 2:55:40]: We have to think about okay, where do we? [2:55:40, 2:55:45]: Where do we have holes? So if I do I drop off the face of Stockbridge, city of Stockbridge Earth. [2:55:46, 2:55:53]: Where do we need to pick up properties to move into the city? So we're looking at annexation opportunities. [2:55:53, 2:55:59]: And and talking with some of those property owners the lat latter part of October. [2:55:59, 2:56:19]: so that we can start the conversation with property owners, take a look at their property, see what their interest is in annexing, and move forward. Of course, the police department is process is underway. So there's a lot of really wonderful and amazing things happening in our city. And I just wanted to commend you all for your service. [2:56:19, 2:56:22]: for your continued support and um [2:56:22, 2:56:27]: Just you know, reaching out to me if you have questions. I'm always available to you. [2:56:27, 2:56:32]: um anytime day or night weekends i'm always on so please feel free [2:56:32, 2:56:34]: to call or text me, email me. [2:56:35, 2:56:45]: Um and again, appreciate my team for all that they've done to bring all this together. And I appreciate you all for the the tough reading you that time reading you had. [2:56:46, 2:56:54]: With this document, but I'm very proud to have moved this forward. And we'll be looking forward to going to the city council on October the 11th. [2:56:54, 2:56:56]: for their approval as well. [2:56:57, 2:57:01]: So um I don't have anything additional. So I think we're at the end of our agenda. [2:57:02, 2:57:05]: And we would need a motion to adjourn. [2:57:06, 2:57:09]: Yes, I'd like to present a motion that we adjourn the meeting. [2:57:10, 2:57:11]: For the planning zone. [2:57:12, 2:57:14]: Do I have a second? [2:57:15, 2:57:16]: I second that. [2:57:17, 2:57:18]: All in favor? [2:57:19, 2:57:20]: Uh [2:57:20, 2:57:20]: Right. [2:57:21, 2:57:22]: All those opposed? [2:57:23, 2:57:24]: That's have it. [2:57:25, 2:57:26]: The meeting's closed. [2:57:27, 2:57:27]: Thank you. [2:57:28, 2:57:34]: Thank you very much, Kerman. Thanks for everybody. Good night. Good night. Thank you. Bye bye.
