[0:17:35, 0:17:51]: number of people here this this evening and I believe they were under the under in the impression I'm sorry that the item for Camler Road was going to be on the agenda. It is not therefore this will not be a public hearing for that item but it it is available for [0:17:51, 0:17:52]: Public comment. [0:17:54, 0:18:00]: Okay, so otherwise the public comment is is based on the agenda items that were removed for November fourteenth. [0:18:00, 0:18:08]: No, sir, that's a totally different item. Okay, I'm sorry. This is a separate um item for Canada Road. It is not an item on the agenda. [0:18:09, 0:18:13]: But it's dealing with a public comment in reference to like a public hearing issue. [0:18:14, 0:18:27]: It's not in reference to a public hearing at all, but if anyone who wants to speak on Canler Road, it would become a public comment, sir. All right, well, okay, fine. So be it. So be it. So we have someone who wants to I'll uh have a public comment reference to Canler Road. [0:18:27, 0:18:29]: do uh terror welch. [0:18:34, 0:18:39]: You don't have any comments? No. Okay. Mark Welch? [0:18:43, 0:18:44]: John Burnett. [0:18:49, 0:18:50]: Operate. [0:18:52, 0:18:55]: Khivi. And Arbor Khivi. [0:19:02, 0:19:05]: Okay, it needs your name and uh address, please. [0:19:09, 0:19:13]: Okay. Please speak into the mic. Yes, sir. All right. [0:19:22, 0:19:24]: Yeah, don't seem like this alone. [0:19:27, 0:19:28]: There we go. Thank you. [0:19:30, 0:19:40]: Aubrey Kakivi, AD Candler Road, representing Southern Grace Hospice. We have two primary choices in life. We can either accept conditions as they exist or we can take responsibility to change them. [0:19:41, 0:19:50]: See a lot of people want to exempt themselves from taking responsibility. All they want to do is talk about the problem. Every time you see them, they'll either tell you their story over and over and over again. [0:19:51, 0:19:54]: Since early twenty twenty one, I have pleaded with the city. [0:19:54, 0:20:00]: To stop the Candlero development over and over and over again. I come to you tonight asking. [0:20:01, 0:20:08]: For you to take responsibility as well as me taking responsibility for myself as the only business owner on Canler Road. [0:20:09, 0:20:18]: I also come tonight on behalf of my neighbors and their children, who do not only live on Kendall Road, but frequently walk and have children who ride their bikes on this semi-dirt road. [0:20:20, 0:20:28]: On June 22nd, 2021, a developer stated in an email to the DOT that they plan to develop this 175 Kandler Road. [0:20:29, 0:20:36]: Forty four acre lot into a truck trailer parking facility and have been speaking with Linda Logan with the city of Stockbridge regarding this. [0:20:38, 0:20:51]: The open records request revealed at the time the project was called Candler Road Industrial Park, a 498,160 square foot warehouse with over 124 tra tractor trailer parking spaces. [0:20:52, 0:21:12]: On July 1st, 2021, Henry County DOT informed the developer of the current County Road conditions, stating that it is a narrow surface treated roadway that was insufficient for tractor trailer use. On October 29th, I sent y'all an email based off of Linder's verb verbal approval and Gordon Linton's zoning verification letter dated May. [0:21:12, 0:21:13]: twenty twenty one. [0:21:14, 0:21:30]: On November 4th, Mayor Ford responded of the mat that the matter was being investigated, and currently the current research has indicated that plans have not been submitted to the city for a thorough review. November 6, 2021, Mayor Ford concluded that the Community Development Director has conducted a thorough research of the zoning requirements. [0:21:30, 0:21:38]: And a truck stop, truck terminal, or parking lot is not allowed under the current L M or M one zoning designation for the property. [0:21:39, 0:21:51]: May twenty sixth, two thousand twenty two, I emailed again that traffic was continuing. Um a stop work order was issued by the prop by the city for work for land being disturbed without a permit. [0:21:51, 0:21:53]: Август форт, твари то. [0:21:53, 0:21:59]: A notice of intent for the project entitled Canler Road Industrial was filed with the city of Stockbridge, august eighteenth. [0:21:59, 0:22:06]: 2022, Brian Gardiner from Safe Built reviewed for code compliance the development entitled Inlight Stock Bridge. [0:22:07, 0:22:26]: Same plans, 498,160 square foot warehouse and over 120 fract for tractor trailer parking spaces that Mayor Ford already stated was not permitted and would require rezoning. August 31st, 2022, a common development permit was issued for the project roject Candler Road Industrial Park. [0:22:26, 0:22:33]: October third, twenty twenty two, I submitted an open records request to this city and only received one email. [0:22:33, 0:22:41]: I humbly request to be able to continue. I'll stand by. Uh Council, I would imagine that you wanted to continue this. Go right ahead, please, ma'am. Thank you. [0:22:41, 0:22:51]: The records included the civil plans for the 498,160 square foot industrial building and parking entitled Canler Road Industrial Park, the development that Mayor you already seized. [0:22:52, 0:22:58]: On june tenth, twenty twenty-two, the forty-three point nine acre property closed to Blackstone Decayler Development. [0:22:58, 0:23:02]: As of the day as of today, the city has no record of a traffic study. [0:23:02, 0:23:12]: or any formal road plans that have been approved for the project by the DOT under the names Inlight Stockbridge or Canler Road Industrial Park. In fact, the developer has stated that the DO to the DOT [0:23:13, 0:23:20]: On two separate occasions that the Jodico Jodico intersection has been addressed and that the city of Stockbridge is in agreement with this plan. [0:23:21, 0:23:31]: Per the City of Stockbridge's Unified Development Code on adopted by all of you on March fourteenth, twenty twenty two, there are a plethora of code violations that prohibit this development from progressing forward. [0:23:32, 0:23:34]: nonetheless obtaining a land disturbance permit. [0:23:36, 0:23:41]: The property closed june tenth, twenty twenty two. It was into conservation until june twenty-seventh, twenty twenty two. [0:23:42, 0:23:48]: Therefore, no permits, project plans, or proposed property use letters submitted or obtained prior to its closure date are valid. [0:23:48, 0:23:56]: When the Unified Tax Development Code was adopted, this property was under a 10-year agricultural conservation or tax shelter, strictly put in place to. [0:23:56, 0:24:00]: protect the property from development and to save the owner's tax dollars. [0:24:00, 0:24:02]: The land disturbance permit issued. [0:24:03, 0:24:20]: Submitted on 8422 2022 includes an attestation that the developer contends all requirements under the City of Stockbridge's Universal Development Code have been met or accounted for in the attached plans. However, as I will outline, and I promise to be quick, that is not the case. Number one. [0:24:20, 0:24:40]: Per our Unified Development Code, Chapter 2, page 46, defines the light industrial district intent is to provide for light industrial uses, all of which shall be nuisance-free and not generators of a hazardous waste. It is intended that the light manufacturing uses shall be located on either arterial or major collector streets or within industrial parks. Canler Road is not. [0:24:40, 0:24:41]: Either of these. [0:24:41, 0:25:01]: Which brings me to number two. Per the city of Stockbridge's minimum development standards on page 99, if Canler Road were considered an arterial or collector street, the developer would be required to have a minimum of 80 to 100 feet of ride of way. They do not have this. Problem three: the letter of intent proposed a warehouse and office, no trailer park. [0:25:01, 0:25:15]: Parking was mentioned as this developer was informed truck parking would require rezoning by our mayor in November 2021. However, on the plan submitted with the name Inlight Stockbridge, over 124 tractor trailer parking spaces surrounded this warehouse. [0:25:16, 0:25:18]: We still have no idea what is exactly getting built. [0:25:19, 0:25:22]: Problem four, the current City of Stockbridge Unified Development Code. [0:25:23, 0:25:24]: The максимум [0:25:24, 0:25:44]: Lot coverage that includes parking per the diagram in the development code on page 47 is 50 percent. That means a new development can cover no more than 50 percent of a total lot. The developer plans includes thirty-five point five of the forty-three point nine acres covered, which equates to over eighty percent of the lot coverage. Again, not in compliance with [0:25:44, 0:25:45]: With code. [0:25:47, 0:25:49]: All right, council, wanna continue? [0:25:50, 0:26:10]: I have one more minute. Stand by. Okay. Go ahead, ma'am. Problem five. It's intended use according to the project summary submitted for a permit is moderate hazard storage, which is defined as buildings occupied for storing any flammable or combustible materials that are likely to permit the development and production of fire with a moderate rapidity. Per stockbridge, unified development. [0:26:09, 0:26:22]: Code, the L1 Indu industrial district is to provide for light industrial uses, all of which shall be nuisance-free and not generous, generators of hazardous wastes. Again, not in compliance with Stockbridge Code. Problem six. [0:26:23, 0:26:36]: Our code on page 139 states that sidewalks shall have a minimum width of eight feet in all commercial, industrial, and mixed use development areas. The site plans submitted to the city do not include a sidewalk, do not include any sidewalk plans at all. [0:26:37, 0:26:38]: In the last three weeks, [0:26:39, 0:26:51]: I have met with or contacted a plethora of you. Gordon Linton came to the site and measured Candler Road himself. The width in front of my property is only seventeen and a half feet, not big enough to even fit two cars through. [0:26:51, 0:26:58]: I've contacted Brenda Carter a total of seven times, in which all I received back was a text asking for my name. [0:26:58, 0:27:07]: I went to City Hall to meet with Ryan and Brenda, who insisted he would call me back and was diligently working on understanding the project. No return calls were received. [0:27:07, 0:27:13]: I have outlined six issues tonight which give you the power to immediately stop this development. [0:27:13, 0:27:21]: That has hastily been pushed through planning and zoning, a development that will significantly impact the safety and well-being of your constituents, the will that will redistrict. [0:27:23, 0:27:30]: That will impact the safety of the children who live on Canler Road and prevent them from riding their bikes as they have for many generations. [0:27:30, 0:27:37]: Henry Evans states, a culture of accountability makes a good organization great and a great organization unstoppable. [0:27:37, 0:27:45]: Therefore, I humbly and respectfully request that the planning and zoning department and this developer, who has presented itself under multiple names, [0:27:45, 0:27:52]: be held accountable to follow the city's minimum development standards and unified development code set forth and approved by this council. [0:27:53, 0:28:13]: I plead that Stockbridge take the opportunity to prove to prove that it is indeed a great, unstoppable city, and immediately sees the development of a warehouse with one hundred and twenty-four tractor trailer parking spaces, whether it be called Canler Road Industrial Park, Inlight Stockbridge, or any other development disguising itself and deliberately intending to mislead the city. [0:28:13, 0:28:13]: City. [0:28:14, 0:28:24]: Let's call a spade a spade. They are taking forty four acres of land and building a tractor trailer parking space spot overnight parking, despite being so this would require rezoning. [0:28:25, 0:28:27]: May I answer any questions the council may have? [0:28:27, 0:28:44]: Uh actually uh what what's gonna happen is that the city uh manager is well aware of this along with the council members, city manager has a charge to uh dig down in this particular issue and get it resolved and at the best as possible in that aspect. Thank you for your comments. Thank you. Appreciate it. Okay. [0:28:46, 0:28:49]: Okay, we will move on. Any any other uh public comments? Um [0:28:50, 0:28:57]: Okay, thank you. All right. Uh on this note uh we will now go on a ceremonial uh basis for the meeting here. [0:28:59, 0:29:07]: And I have several proclamations to read. Council, you will be willing to join me if you want down here, if you like. And I'll call it as a point in time. [0:29:08, 0:29:09]: You go through this part. [0:29:29, 0:29:37]: We'll start with the uh Spider Cord Awareness Month. Mr. Ash, sir, you are here? Joshua Ash? [0:29:43, 0:29:51]: Oh is that right? Okay, is that what we do with [0:29:53, 0:30:01]: I know, sir. No, I'll be okay. So you want that to go first before I start a meeting? [0:30:04, 0:30:24]: All right. All right, just a proclamation of City of Stock Ridge recognition of Spinal Cord Awareness Month. Whereas a spinal cord injury refers to any damage to the spinal cord, whether from trauma, disease, or degenerative disorder. And whereas after a spinal cord injury, nerves above the level injury keep working as a [0:30:24, 0:30:44]: Did before, but messages from the brain to the body may become fully or partially blocked below the level of injury. And whereas to raise awareness about this prevalent issue in 2014, the U.S. Senate resolution 533 recognized the month of September as national spinal cord injury awareness. [0:30:44, 0:31:04]: Awareness Month. And whereas people with spinal core injury can continue to live full, productive, and rewarding lives, to do so, it's essential that they have access to the resources they need, including spinal core injury, rehabilitation, medical care, quality jobs, education, mental health treatment. And whereas the city of Stockbridge recognizes [0:31:04, 0:31:24]: It is vital that we continue to have informed, resourceful, and productive conversations about how to improve policies and resources for people with disabilities. These conversations help spark ideas and increase support around the research and discovery of effective treatments and therapies to help those with spinal cord injuries. Now, therefore, I am [0:31:24, 0:31:44]: Anthony S. Ward by Virtual Authority Ves McNey as the mayor of the City of Stockbridge, Georgia. And on behalf of City Council members, Ellen Alexander, Milana Barber John, Kesia Gantt and Aphonso Thomas, who hereby encourage everyone to join us in raising awareness of spinal core injuries in our community. A witness thereof, I have here to uh set my hand [0:31:44, 0:31:52]: I'm the Great Seal of the City of Stockbridge, Georgia, on the 10th day of October, year of our Lord, 2022. And I signed this along for our tour of Promessa Holiday. [0:31:56, 0:31:57]: Okay. [0:31:58, 0:32:03]: If we have a well, if you have a proper uh I maybe you'll necessarily mean it might the floor is yours. [0:32:04, 0:32:12]: Mayor and Council, I would like to thank you all for presenting the proclamation and most importantly, Mr. Lutation, I would like to thank you. [0:32:14, 0:32:17]: Okay, thank you very much. Appreciate that. [0:32:19, 0:32:30]: You gonna show something to us here? Yes, I'm not sure if it's gonna have audio because it was just handed to me, so I will try my best to get this played. [0:32:32, 0:32:34]: I would like to you know turn I can't I can't [0:32:36, 0:32:44]: I'm sorry, I'll let it turn. I can't I can't. Okay. Okay, here we go. [0:32:50, 0:32:51]: Call me crazy bird. [0:32:52, 0:32:53]: Don't touch my truck. [0:32:56, 0:32:57]: Yep, yep. [0:32:59, 0:33:01]: Don't touch my truck. [0:33:05, 0:33:13]: Don't touch my wood grain dash with the matte black finishing Match my shautie with the big off buttons. [0:33:14, 0:33:21]: No them boys off cause I got hard business. You can show me if you wanna go and test your luck. [0:33:21, 0:33:23]: Set up, give me. [0:33:23, 0:33:25]: Back to six. [0:33:27, 0:33:30]: Sua estija. Quero sair, eu não quero. [0:33:50, 0:33:58]: We need to make taking pictures. We need we need to make sure we take pictures of all this here. [0:34:02, 0:34:04]: And [0:34:09, 0:34:14]: I'm gonna do this two ways. Okay. [0:34:15, 0:34:22]: Get this one and then I'm gonna come for the other side so I can get the seal in the background. Okay. [0:34:32, 0:34:35]: Fantastic. Congratulations. [0:34:45, 0:34:46]: Okay. [0:34:47, 0:34:47]: Four. [0:34:50, 0:34:53]: Ms. Taylor, are you present? [0:34:55, 0:35:03]: Taylor? Okay, this is in reference. Come on, Ms. Taylor, please. This pro next population is uh domestic violence awareness month. [0:35:05, 0:35:25]: How are you? All right. All right. Yeah, okay, what's coming on the side? Problem basic city is stock race, George, recognition of domestic violence awareness month. Whereas in October is able to recognize the National Domestic Violence Awareness Month, and whereas domestic violence in the pattern of [0:35:25, 0:35:28]: [2129.4, 2149.4]: Intimidated partner, current or former, uses to gain and maintain control over another. This abuse can occur in the form of physical, verbal, emotional, sexual, and economic control. Veterans often use these multiple tactics such as isolation, intimidation, sexual, and physical association. [0:35:49, 0:36:09]: Assault forced to substance abuse assaults threatening or assessive monitoring to control and manipulate victims and survivors. And whereas domestic violence affects maities across the US, regardless of cultural background, ethnicity, sexual orientation, faith, social economic status, ability, or educational background. [0:36:09, 0:36:29]: This means it's very likely we would all know someone who is a victim or survivor and someone who is an abuser. And whereas victims and survivors need comprehensive services, but more so genuine and non-judgmental support from friends, family, and our community. [0:36:29, 0:36:49]: Education and awareness are critical components of an effort to end domestic violence. Please contact Aiden House at 770-954-1008 or the crisis line at 770-954-9229 for local health and assistance. Now therefore I am [0:36:49, 0:37:09]: Award by virtual authority best and me as the mayor of the city of Stockbridge, Georgia. And on behalf of City Council members Elden Alexander, Elana, Barber, John Bon, Peace, Gannon, and Afonso Thomas, we hereby proclaim October as domestic violence and awareness month in the city of Stockbridges. And we call on all citizens and communities to join the movement to end domestic violence. [0:37:09, 0:37:28]: violence. We must do our part to support victims and survivors and come together as a community to end this abusive behavior. And witness thereof I have here to set my hand, the great seal of the city of Scott Bridge, Georgia, on the 10th day of October, year of our Lord, 2022, my son Clerk and Isaac. [0:37:43, 0:38:02]: Do you have any comments then? Um I would like to say thank you again for men and women and just to tell you all to speak up, you know, your voice can be heard to save someone's life. It's nothing to be embarrassed about. Or if you know anybody that's suffering in silence, say something because just saying something can save someone's life. [0:38:02, 0:38:07]: [2288.0, 2308.0]: This next one is actually breast cancer awareness month. So uh kind of gonna pick this month, obviously, right? All right. In this aspect. So uh I don't know if there are any breast cancer survivors uh that are present that want to come forward. I will read this regardless. Anybody? All right. All right. [0:38:27, 0:38:47]: Whereas breast cancer is the most common type of cancer among women in the world, a second leading cause of cancer death among women in the United States. More than one in eight women and one of 833 men in the U.S. will be diagnosed with breast cancer in their lifetimes. Whereas breast cancer awareness month began in 1915. [0:38:47, 0:39:07]: 1985 as a partnership between American Cancer Society, Imperial Chemical Industries, Pharmaceuticals, AstroCeneco. And whereas we encourage all women and men to find out if they are at an increased risk to learn more about their amendments and screens by speaking with their health care providers earlier. [0:39:07, 0:39:27]: And whereas during breast cancer awareness month, we recognize that women and men courageously fight to survive, protect, treat, prevent, as court survivors of this devastating disease. And if you are a breast cancer survivor or have been recently diagnosed, October is a great time to be reminded. [0:39:27, 0:39:47]: remind you and that you're not alone. Now therefore I am asked for by virtue of authority investing me as the mayor of the city of Stockbridge, Georgia, on behalf of City Council members Elton, Alexander Yolon, Barber John, TC Gannon and Afonso Thomas, who hereby proclaim October as breast cancer awareness month in the city of Stockbridge, and we encourage and [0:39:47, 0:40:07]: Invite everyone to join us on Saturday, October 15th for the city's annual Pink Love Walk Community Park as we walk in supportive and in remembrance of those impacted by breast capsules. That's my way that starts at 11 o'clock. And witness thereof I have here unto set my hand, the great seal of the city startup is Georgia on the 10th. [0:40:07, 0:40:16]: Day of October year run lower of 2022. And I signed this along with my product that's a holiday. Okay. [0:40:31, 0:40:36]: So in a reference to a world mental health day, Miss Myers, please. [0:40:40, 0:41:00]: How are you? All right. Um up a little closer. Okay, proclamation once again, City Star Prince Georgia recognition of World Mental Health Day. Whereas the World Health Organization recognizes World Mental Health Day on October 10th of every year, whereas the [0:41:00, 0:41:20]: Theme of 2022's World Mental Health Day is to make mental health and well-being for all a global priority. And whereas mental health problems exist in our lives with our families, the workplace, and throughout communities impacting everyone, the COVID-19 pandemic highlighted and exacerbated the global mental [0:41:19, 0:41:39]: Health crisis, fueling short and long-term stresses and undermining the mental health families. Estimates put at the rise in both anxiety and depressive disorders at more than 25% during the first year of the pandemic. At the same time, mental health services were severely interrupted and the treatment. [0:41:39, 0:41:59]: Gap for mental health conditions was widened. And whereas World Mental Health Day is a chance to talk about mental health in general, how we need to look after it, look after it, yes, and how important it is to talk about things and get help. If you or someone else knows if they're struggling. [0:41:59, 0:42:19]: Stigma and discrimination continue to be a barrier to social inclusion and access to the right care. But we can all play a part in increasing awareness about which preventive mental health interventions work. Now, therefore, I am transformed by virtual authority invested in me and as a mayor of the city of Stockbridge, Georgia. [0:42:19, 0:42:39]: On behalf of City Council members Alexander, Lada Barber, John Blount, Lakesa Gantt, and the Father Thomas who hereby proclaim October 10th, 2022, as Rural Mental Health Day and CS Stockbridge, and we encourage everyone to show your support in making mental health a priority in our community. A witness thereof, I have here unto [0:42:39, 0:42:50]: set by hand, the great sealed city of Stockbridge, Georgia, 10th day of October, year of our Lord, 2022. And I signed this along with our clerk for Mesa Holiday. [0:43:04, 0:43:24]: Please and well any any words that you want to order to us, please. Um I just want to say thank you so much. I'm so excited that I've been doing this work for about thirty years and before it was even, you know, really spoke about a lot with a lot of things and stigma attached to it. So I'm grateful for being able to, you know, to serve everyone from homeless domestic violence. [0:43:24, 0:43:35]: you know, depression, anxiety, all types of mental health in children and adults. But I'm just grateful to receive this and I'm hoping that people continue to seek out services and mental health services. [0:43:40, 0:43:41]: I guess. Um [0:43:42, 0:43:44]: I'm a living testimony. [0:43:46, 0:44:06]: And uh my story started a long time ago when I was a child and I didn't know anything about any any help when it comes to mental health. But I witnessed a lot, I wit witnessed domestic violence, I went through things as a child that I shouldn't have gone through. [0:44:06, 0:44:07]: Yeah. [0:44:07, 0:44:10]: Ten years ago I didn't want to be here anymore. [0:44:11, 0:44:18]: Thank goodness I was a veteran and I decided to call Veterans Hope. [0:44:18, 0:44:36]: And I'm still here, I'm still fighting, I'm fighting for myself and I'm fighting for others. Because people still don't want to, you know, think about how big of a difference it will make when people are killed. [0:44:39, 0:44:41]: Thank you. [0:44:44, 0:45:04]: Okay, National Women's Small Business Month, the show. And any any of your lady friends that want to come on up, come on. Please. Well I mean all ladies. I'm sorry. Come on. [0:45:28, 0:45:37]: Okay, quote myself Yeah he pop in because okay stop there is don't recognition national women small service one. [0:45:38, 0:45:46]: Whereas October is national. All right. [0:45:48, 0:46:08]: Whereas October is National Women's Small Business Month, which means it's time to recognize women-owned businesses everywhere, as well as outstanding progress female entrepreneurs have made over the years. And where starting a small business was once considered an undertaking. [0:46:08, 0:46:28]: primarily for men times and changes. There are currently over 12 million women-owned businesses in the United States. They employ nearly 10 million people to generate over 12, excuse me, 2 trillion in annual sales revenue. Whereas in October 1988, President Ronald Reagan assigned HR, for some House Resolution 50-50 [0:46:28, 0:46:48]: The Women's Business Ownership Act. This legislation increased federal support for all women-owned businesses and made it easier for female entrepreneurs to get working capital and business training assistance. Before this bill was signed into law, some states require women to have a male family member co-signed on the business loan applications. [0:46:48, 0:47:08]: Whereas entrepreneurship is a booming for women in the United States and various businesses, women are making a significant impact in professional services, healthcare, social services, educational services, and apparel and accessory industries. Now, therefore, I am scored by personal authority best of being as the mayor of the City of Stock Race, Georgia. On behalf of City Council. [0:47:08, 0:47:28]: members of Dallas and Lama Barber John Club and KC Gannon and Father Thomas do hereby proclaim October as National Women's Small Business Month in the City of Stockbridge Georgia. Witness thereof I have handed here unto set my hand with great seal of the city of Starbucks Georgia on the 10th day of October of the year of our Lord 2022 and assigned [0:47:28, 0:47:31]: [2852.1, 2860.6]: [0:47:46, 0:47:48]: You got in there? [0:48:37, 0:48:38]: The gene is right. [0:48:40, 0:48:42]: Favorite. [0:48:43, 0:48:46]: A tiny team for a name line in helping show its agency. [0:48:47, 0:48:49]: Like beyond waterable wall rich. [0:48:49, 0:48:50]: [2934.0, 2935.1]: [0:49:19, 0:49:39]: Again, we think uh setting a stock raise. I want to make sure um while I have this public space to please come out to our funding pitch is going to be October 26th. It's gonna be at Merrill Mammers Conference Center, and we are there to fund a woman-owned business. So far we have funded four women-owned businesses, and so we're [0:49:39, 0:49:40]: [2989.4, 2992.8]: All right. [0:49:54, 0:49:58]: Yeah, okay. Yeah, come on up a minute. Uh solve okay. [0:50:01, 0:50:05]: Work this way, work this system. [0:50:07, 0:50:08]: Okay. [0:50:31, 0:50:40]: All right, good deal. Thank you. All right. [0:52:17, 0:52:18]: Nor do I hold [0:52:19, 0:52:23]: Any other office of trust of the government of the United States? [0:52:25, 0:52:26]: On this thing. [0:52:27, 0:52:30]: Or any foreign state as prescribed [0:52:31, 0:52:32]: By the wall. [0:52:32, 0:52:34]: Of the state of Georgia. [0:52:34, 0:52:36]: Uh so long with a firm. [0:52:37, 0:52:39]: That are fully qualified. [0:52:40, 0:52:50]: Under the constitution and the laws of the state to hold the office, Citywide Development Authority Board Member. [0:53:33, 0:53:41]: Congratulations, got that little software in there. [0:53:41, 0:53:49]: No, we all we've all need to sign these documents here, but while we're doing this, any you have any comments that that you want to make publicly here to everybody? I'm here to support City of Soccer as I have over several years and this would have been an official format. [0:54:17, 0:54:37]: Sir, if you have any comments, go ahead, please. Um, and the memory accounting um I think we have to prove it. So I'm not out here and I'd like to see um. [0:54:37, 0:54:42]: uh a great edition and we're reporting that I think we got [0:54:42, 0:54:59]: Okay. Oh, after training. I get that training. Do you sign many more or [0:55:08, 0:55:12]: Have a great day, the city of Scarborough. All right. [0:55:15, 0:55:16]: I think it's a both. [0:55:20, 0:55:25]: Okay. I will give me one second. So she'll take me just a second. Yeah, you wanna put that back while we take photos? Okay. [0:55:27, 0:55:37]: So um you want to seal the background here? Yes, please. Okay. But let's let's kind of look at this which you get from this angle. Please run it. [0:55:39, 0:55:40]: [3344.4, 3346.3]: [0:55:57, 0:56:07]: Thank you. Congratulations to March. All right. Okay, good. [0:56:08, 0:56:10]: So right here. [0:56:29, 0:56:40]: All right. What's next on our agenda would be a presentation of FY twenty twenty three annual operating budget and capital improvement plan. Mr. Gardner, please. [0:57:31, 0:57:32]: Alright. [0:57:33, 0:57:35]: Good evening, Mayor and Council. [0:57:35, 0:57:55]: Evening. Uh tonight. Uh my goal is to present to you uh FY twenty-three budget. And um so my goal for the presentation is to kind of reflect our funding for some key areas as well as kind of give you guys a high level view of the budget, and it might be a little bit more detailed. [0:57:55, 0:58:14]: detail than than you might be accustomed to, but um also talk a little bit about some of our challenges and some opportunities that have that have come awry and then get some some consensus from you guys as to how I wanna move it along and if that's okay with the council. [0:58:16, 0:58:36]: So as you guys know, early this year we worked with our strategic planning partner to come up with our strategic plan, our five-year strategic plan. We work with our staff in reference to after our meeting with the council back in February. Uh and our consultants are f finalizing our plan. Hopefully we bring that to you guys. [0:58:36, 0:58:56]: But we also wanted to kind of talk about funding in some areas around uh our four focus areas, which was our quality of life, cultural and brand development, economic growth, and sustainability. And with that, we've obviously provide funding in some of the key areas. And this is just a highlight, it's not all inclusive. [0:58:56, 0:59:09]: Um, but funding obviously to our park master plan, our continued funding for our public safety, as we noted, that's a high quality of life issue, as well as our infrastructure improvements over the next uh [0:59:10, 0:59:24]: fiscal year. Uh as it relates to brand obviously to keep funding for our amphitheater and have some cost savings associated with that in terms of change in venue management, but also funding for looking at potential funding for our cultural arts center. [0:59:24, 0:59:27]: And then also working around our way finding program. [0:59:28, 0:59:44]: As relates to economic growth, obviously the council has CFA to start uh development authority, citywide development authority, which is funded under the budget, but funding also for the D DA and I will try to leverage funds outside thereof for additional funding for both of those entities to operate. [0:59:44, 0:59:47]: Also part of that is working on some key [0:59:47, 0:59:52]: some key incentive programs around our tax allocation district, our TAD. [0:59:52, 1:00:12]: as well as opportunity zones and enterprise zones where we can properly put them. So we're working in this on that sustainability, obviously one of the key things we've heard about is how do we reduce our carbon footprint for sustainability. We're working on that through charging stations, as well as uh looking at stormwater so that we don't get any descent concrete around storm. [1:00:12, 1:00:22]: water management. And I'll tell you today I had to stop and pull over and tell some guys they were blowing leaves on Country Club Drive into the street. And I'm like, guys, what are y'all doing? You all supposed to pick this stuff up. [1:00:23, 1:00:27]: Um you're not supposed to do that'cause it gets in the storm drain, but they were just blowing as they go. [1:00:30, 1:00:41]: So some of the highlights and priority areas. Obviously we talk about infrastructure improvements and continuing moving in that phase. Obviously in terms of parks improvements, making sure we do some uh additional things around our parks. [1:00:42, 1:01:02]: Which are all passive and not act active. We don't host recreation programs. Um implementation of all of our SPLUS funded projects, making sure we keep in compliance with our SPLUS laws, but also moving those projects forward. Um implementing some changes in technology, and you'll start to see some of that around our work, our website, as well as some of the software that we're hoping. [1:01:02, 1:01:22]: To put in place over the next fiscal year. But also one of the big things is obviously road paving, making sure we continue our road paving. And as uh our public works director informed you guys recently, we're about, you know, last year we completed around five miles of roadway resurfacing, repaving, as well as sidewalk improvements at about two miles. [1:01:22, 1:01:25]: miles. So our goal is to continue moving in that area. [1:01:26, 1:01:29]: And one of the key projects in Dear to My Heart is downtown redevelopment. [1:01:30, 1:01:32]: And as you guys know, we've been working around [1:01:32, 1:01:44]: Um the downtown with our market analysis as well as me working with some developers to talk about interest in our downtown areas, specifically those properties that we currently own where we can get a lot of traction around. [1:01:44, 1:01:55]: revitalizing the downtown area and turning the face of our downtown around. Um, I did mention economic incentives. That's one of the key things, some key tools we're missing out of our toolbox that we need. [1:01:56, 1:02:00]: Um and can utilize and I mentioned that earlier some round uh tad. [1:02:00, 1:02:13]: That's going to be a huge deal to make some things happen here in the downtown area because as we grow residential development in the downtown, there's going to be a need for parking. And that'll be one of the key things we're going to have to address is structured parking downtown. [1:02:14, 1:02:21]: Um some of the key indicators of that is making sure right now we've got some grant monies that we're going after to connect uh [1:02:22, 1:02:42]: the west side of the train tracks with the east side of the train tracks. Uh and that's gonna be a huge deal through some of the federal funding that we got. And um we're real excited about the funding opportunities around that. And that's gonna help from an economic development standpoint,'cause somebody who lives here can tr easily traverse it when we build, can traverse over to the other side to [1:02:42, 1:02:46]: to entertain wine and dine uh as we go downtown. [1:02:46, 1:02:51]: Um continuing to look for funding options to fill that gap for the Cultural Art Center. [1:02:51, 1:02:53]: And then as we mentioned earlier before. [1:02:53, 1:03:06]: Focusing and making sure that the police department gets where they need to be, as uh our chief and his command staff say, not the best police department in the state of Georgia or the South East or the United States, but the best police department in the world. [1:03:09, 1:03:29]: So this year our for overall funding across all funds for the city is right at forty two forty nine point two million. That's uh twenty one point seven million for our fund balance, about a million dollars in grants. Hotel motel about three set three hundred and seventy five thousand. And we propose to see that increase because we're they're look [1:03:29, 1:03:40]: likelihood is we'll have four new hotels coming online um next year. We got two, three currently under construction. So two over in the Eagles Landing area, one over [1:03:40, 1:03:59]: on the west side of town on highway one hundred thirty eight and there's a proposal for an additional hotel that I'll talk to you guys about tonight um in the Eagles landing area around the hotel. But our overall budget for the year across all funds is forty nine point two million. [1:04:01, 1:04:08]: So how is that distributed in terms of general fund 21.7, uh sanitation one point nine? [1:04:09, 1:04:11]: Stormwater just over a million. [1:04:11, 1:04:27]: Uh water sewer fund one point nine million. Uh water fund two point three million. Uh capital outlay citywide is three point thirteen point five, URA one point two, uh grants red out a million dollars. And that accounts for that forty nine point two million. [1:04:31, 1:04:51]: So when we talk about how those expenses are even broken down even further, as you know, our number one resource is our people. And obviously in any organization you're gonna be people heavy in local government. So right now we're budgeting across all departments in the city eleven point five million uh for contracts and services. We're right at [1:04:51, 1:04:52]: I don't get enlarged. [1:04:54, 1:04:55]: Go on. [1:04:57, 1:05:00]: I can't even see what's on the screen. Oh [1:05:01, 1:05:12]: Uh three point eight million. Uh supplies across the city, one point four one point five million. Uh capital outlays in the general fund right at four hundred and seventy eight. [1:05:13, 1:05:22]: Um other costs sixty one hundred and sixty two thousand and other financing uses, which is usually our debt service for all of our bonds and so forth at four point two million. [1:05:26, 1:05:28]: Talk a little bit about our capital fund operations. [1:05:31, 1:05:33]: So in our capital fund operations [1:05:33, 1:05:39]: Um when we talk about revenues and remember your budget is not predicated on expenses, it's predicated on revenues. [1:05:40, 1:05:51]: So that's that's the key thing we have to look at. Your budget is not predicated on expense, it's predicated on ex on revenues. So revenues being generated through our taxation, and I'll break that down a little bit further for you, is right around [1:05:52, 1:06:01]: Right around 12.2 million from license and fees. We propose to hover around thirty uh three one point three million dollars in uh license and permits. [1:06:02, 1:06:05]: Excuse me, intergovernmental about one point two. [1:06:05, 1:06:17]: million, charges for services, three hundred and sixty five thousand. Fines and forfeitures right around nine hundred and ten. As you know, we started our new police department. So we now see we'll see some growth and especially in our fines. [1:06:18, 1:06:20]: As these guys go about doing their jobs. [1:06:21, 1:06:33]: Um investment income obviously is a little to none because we don't do a lot of major investments. Um but some miscellaneous income around four point seven and other sources just under a million dollars for a total of twenty one point seven million. [1:06:39, 1:06:59]: So when we talk about percentages, what is you know, what's our major source of revenue is it's gonna be coming from taxation, of which I'll even show you a a break further breakdown of what that looks like. But lost is our number one. And that's where we have some potential challenges. And I'll talk about those challenges as I go through the presentation. Um, as you know, we're in our final year. [1:06:59, 1:07:19]: Of loss, and we're in negotiations with the county regarding loss. And we sent you guys an email kind of updating you guys as to where we were with uh loss negotiations recently. So we're proposing to keep the loss split as they have been over the last 10 years. The county obviously is disagreeing with that, thinking that somewhere [1:07:19, 1:07:39]: Around seventy plus or more percentage of the loss should come from should go to them. Uh and so we had a meeting rec last week, Wednesday, we're prepared to go to arbitration. And um I kind of set out the rules to you guys in that memo as to how we're gonna move forward on that. But that's our number one source. [1:07:40, 1:08:00]: The miscellaneous income is another one of our major sources, fines, uh intergovernmental agreements, and permits. So right around 59% of our income comes from which should be your loss, your hotel motel, your liquor tax, um, insurance, premium tax, all those added up for your taxes. [1:08:00, 1:08:00]: [4084.0, 4092.6]: And this is what that looks like when we break it on down even further in terms of what we're proposing for lost. And so that loss number is gonna be a variable. [1:08:13, 1:08:21]: Um, we don't know exactly where we're gonna end up. Right now the county is proposing that we stay at the same for the first year, which is 6634. [1:08:22, 1:08:24]: Um but if sometimes they agree [1:08:25, 1:08:34]: Um to us to something different, obviously and we come to an agreement and that percentage dropped, that has a potential effect on on what our loss would overall be. [1:08:35, 1:08:40]: That's one of the biggest areas that that we have to look at um as it relates to our loss. [1:08:45, 1:09:05]: And as I mentioned before, uh budget, primarily these are the key areas around your budget when you develop your budget, your general fund, fiduciary funds, which are like your investment and pension, um, your enterprise funds, which we have three of water, sewer, sanitation, stormwater, uh special funds, which is SPLOSS and Grants, capital funds. [1:09:04, 1:09:12]: Fund, which is usually funded through uh capital, can be funded through grants, but major funds usually general fund and enterprise funds. [1:09:16, 1:09:28]: So when we talk about the general fund and how that's how those one that twenty-one point seven is distributed, um you will see by your chart. Oh, excuse me. [1:09:30, 1:09:50]: You'll see by your chart that public safety. And in most go governmental agencies, whether you have police or police and fire, that's usually your number one, that's where the bulk of your general fund revenues go to funding. It's public safety. So for us, we just have police, right? So police is gonna be our biggest department, it's our largest department by man. [1:09:50, 1:09:52]: Manpower, but also by equipment. [1:09:53, 1:09:55]: Right, so they make up about thirty four percent. [1:09:55, 1:10:03]: Uh where the money goes into the general fund, Public Works S next, which is the second biggest department usually in most governments, public works. [1:10:03, 1:10:06]: Right around eighteen percent, planning and development ten percent. [1:10:07, 1:10:23]: Uh other governmental entity uh activities, right around nine percent, governmental body three percent, city clerk two percent, executive four percent, finance four percent, governmental buildings um five percent, and economic development at two percent. [1:10:27, 1:10:47]: So to kind of give you a brief history of where we have been with our general fund over the years and as we continue to diversify and grow as a city, obviously, so grow with our uh operational costs. So over the last five years, we've gone from ten point eight million to twenty-one point seven million with last year. [1:10:47, 1:10:52]: year on and this is un unaudited, but eighteen point four million for the general fund. [1:10:56, 1:11:01]: Talk a little bit more about our capital and where we are with our capital outlays. [1:11:01, 1:11:02]: For the next year. [1:11:04, 1:11:08]: This kinda gives you a breakdown of our capital program um by department. [1:11:09, 1:11:10]: Right. [1:11:22, 1:11:32]: So public works, as you will know, makes up the bulk of our capital in terms of where that revenue goes to. And a lot of that I'll break down even further so you'll get a good idea of where those funds come from. [1:11:33, 1:11:43]: Um but public works is number one, water sewer, number two, uh public safety is number three, stormwater and the Merylanders is four, five. [1:11:46, 1:12:06]: So when we talk about even a little bit more drill down in terms of what's in the capital budget, um police tactical gear and equipment at one point 1.6 million, uh equipment for parks or improvements to our parks, about 300,000, resurfacing program, a million dollars, road ray intersection improvement. [1:12:06, 1:12:23]: And you'll see our funding sources for those is typically SPLOS or T SPLOS and a few general funds. And we have some APA funds that we're putting towards the court building at 84,000. But our water and sewer systems, 3.3 million, water distribution, 600,000. [1:12:23, 1:12:34]: Uh five point five million dollars, which is our Ts plus Plus, uh at five point five million, city repairs three hundred thousand, well man is two thirty nine, uh stormwater upgrades are three hundred and fifty thousand. [1:12:39, 1:12:59]: So to talk about our budget process and how we started, we you know we developed a calendar sender back to you guys back in June, kinda outlaying um our dates and times where we'd be going. We did some of our projections around our revenues. Um then we asked our departments to work on what their expenditures would be for the air for the FY twenty three budget. Um [1:12:59, 1:13:16]: They work with that with us. We reviewed it, went through it, made some cuts. We'll still make some adjustments even after we give you this documents. There'll be some adjustments being made um in the budget. Um but our overall is to stay under our revenue numbers. So we'll just be moving some numbers around. [1:13:16, 1:13:27]: um in certain departments as we go along. Uh changes and adjustments to the budget. We talked about um submittal the council. So under our ordinance section six point two four [1:13:28, 1:13:30]: You, the city council, are required to get the budget. [1:13:31, 1:13:35]: Sixty days from the date of adoption. That sixty day would be November second. [1:13:36, 1:13:41]: I buy a calendar date for this year. You guys are getting it on October tenth, that gives you roughly about [1:13:41, 1:13:43]: Two and a half months to review the budget. [1:13:44, 1:13:48]: Right, um and gun backs requ with comments and I'll get into that a little bit more. [1:13:50, 1:13:52]: So when we talk about the timeline. [1:13:52, 1:13:56]: Um, we're out at this. We're I'm doing this presentation and submitted to you tonight. [1:13:57, 1:14:17]: Our goal is obviously to get uh put on the on our agenda for October 25th question and answer. So hopefully between now and then you guys will have some questions. But look hopefully what I would hopefully to do for expedience and efficiency and effectiveness is that as you go through, email any of your comments to us, we'll address them. All of those comments we're [1:14:17, 1:14:31]: When we apply for our GOFA award, which I think will be the first time the city's actually gotten one and if we get it this year, we're gonna apply. We wanna put all the city councils comments as an appendix in that application, in our document. [1:14:31, 1:14:40]: Right, so they will see that council was involved in the process and they'll have someone to see where those questions were that you guys have. But that'll help us get through the process. Our goal is [1:14:41, 1:15:01]: for council to have the first read of the budget um on November twenty ninth. We'll have the first read of our budget and then the second read of the budget December twelfth and the adoption of the budget and then we just go forward. So my goal is hopefully we're not at the last minute as I saw as a as a resident last year where we were [1:15:01, 1:15:03]: We were switching numbers at the last eight. [1:15:04, 1:15:18]: It's not a really good good view when you're doing that. So hopefully over the next two and a half months you guys will give us all your questions. We'll make any amendments necessary. And then hopefully walk out with a budget with a balanced budget adopted December twelfth. [1:15:19, 1:15:39]: All right, so what I understand and this is the introduction to this. This is the introduction, higher level over overview for you guys. This uh the PowerPoint is included in in your pocket with the budget. So any questions you guys have as of today, just send them to us, we'll answer them and we'll keep track of those questions those answers as we go with the dates. [1:15:39, 1:15:59]: And at the end, when we put together the GOFA budget, which is going to be a little bit more expansive than this, you will actually have, we'll talk a little bit more about the demographics of the city, which will look at incomes, housing costs, a lot of that other stuff the GOFA wants to see what's going on. Not only will that [1:15:59, 1:16:02]: help us with a GOFA award but actually when we [1:16:03, 1:16:13]: look to go and apply for a bond rating so we'll know exactly what the city's creditworthiness is, right? What our score is. And mind you, you might get a score double A. [1:16:14, 1:16:19]: One or two, that doesn't mean within a year or two, if we do some things, they'll move us up. [1:16:20, 1:16:40]: to a triple A rating. Um but definitely to apply for a bond rating for the city. I think it's high time that the city does that because as we move forward on some other major projects, that bond rating determines what our creditworthiness is going to be and what interest we pay on any future debts that we may have. As well as you know making sure [1:16:40, 1:17:00]: we keep some props some capital projects going. So this was just a presentation, a high level overview for you guys tonight. We'll be back at it again on the 25th to take any questions you might as generate it between now and then and then obviously keep it moving until we have a satisfactory document that everybody feel comfortable with and we can move forward with FY23. [1:16:59, 1:17:00]: January one. [1:17:01, 1:17:03]: All right, sir. Thank you for the presentation. [1:17:05, 1:17:06]: Just briefly. [1:17:06, 1:17:26]: If you would, and for us um for the general public to understand how aggressive the city how fast the city is growing in terms of economic development over the last few years, economic development has has accelerated and has actually pushed our revenue up. And then uh on the other side of that. [1:17:26, 1:17:46]: That we are pursuing every available federal dollar uh that's on the table, the infrastructure money, the uh and we have a dedicated grants person. Could you talk about that a little bit? So folks can understand that we're going after dollars in for the city. Yes. So in terms of an outside from a lot of uh [1:17:46, 1:18:06]: And from a grant standpoint, we are tapping every federal resource that we have out there in terms of what we can qualify for as a city of our size. Um we're looking at them especially to help around operations. I will tell you the biggest area where we're where we seek seek to see some gains is gonna be around public safety because as you know that's been a huge [1:18:06, 1:18:26]: If you haven't been paying attention to some of the ads that's been going on for the upcoming election, crime is a big deal. And I think that there's been funds put out there to help us. Obviously, we some of it is very competitive, which we have to apply for. But that's gonna help us a a big deal around um additional resources for public safety. But all not also public [1:18:26, 1:18:28]: public safety but also around public [1:18:29, 1:18:49]: um public works. So there's a lot of infrastructure monies out there that we're looking at and going after. One of them is being the bridge project and we've worked closely with GDOT and they felt strongly that the application that we submit will be s will be funded by the administration to give us the opportunity to go through the planning process. [1:18:49, 1:19:09]: Once that done, that document can then be used to actually put for implementation, which is construction of the bridge. The w pedestrian bridge, let me say that. Yes, ma'am. Yeah, go ahead, Ms. Gan, I'm sorry. You mentioned some of the grants. We hired someone this year in regards to grants. Are they managing the grants or are they going [1:19:09, 1:19:29]: Or writing or going after the grants and writing and applying for those grants. So until we they will be managing the grants as we get them in uh uh in conjunction with the departments, because obviously the departments will be the ones implementing, but they're also making sure that we're writing policies because that's one number one. We didn't have any grant policies. So [1:19:29, 1:19:49]: She's had to develop a lot of those policies and some of them is on the agenda tonight. One of them on the agenda tonight. Where we talk about, you know, how we do certain things based on the grants that we get, whether they come with federal requirements, because as you know, federal grants come with a lot of requirements, and we've got to adhere to those. But just having grant policies, so I know she's done a lot of that, but she's also [1:19:49, 1:20:09]: Work in conjunction with Public Works and the police department around getting them grants that we and you guys send to us. She's already in that pipeline looking at those and making sure that we qualify for those and applying for those in conjunction with the departments because it's not a one-person. A grant person doesn't write grants by themselves, they write grants in [1:20:08, 1:20:16]: In conjunction with the department in which they're working with, because they're the source of the information that she would need to make those happen. And that's a good thing. [1:20:17, 1:20:18]: Thank you. You're welcome. [1:20:19, 1:20:23]: Any other questions quickly for this or Miss Barber, you have anything in r right now? [1:20:24, 1:20:28]: Okay, all right. Thank you, Mr. Gardner. Appreciate it. All right, good deal. [1:20:30, 1:20:50]: Council consideration to approve change order from the summit construction for amphitheater parking lot improvements on North Lee Street. Original amount uh was$108,554, adjusted to$750,007 and 81 cents with a savings of$51,500. [1:20:50, 1:21:02]: $146.19. Funding source is from SPLOS, presented by Mr. Aaron and Skip Layton on this. Thank you, gentlemen. Please. [1:21:03, 1:21:03]: Number one. [1:21:05, 1:21:06]: Let's go on here. [1:21:13, 1:21:28]: Yes, Mr. Mayor and Council. During uh last month work session, uh Falcon Design reviewed the proposed change order and realized there was a possible chance for some savings. So tonight Mr. Skip Layton is here to present that information. [1:21:30, 1:21:31]: Thank you, Dacius. [1:21:31, 1:21:48]: Mayor, Council. As we stated, uh and I do want you to understand that before that came to you originally, we had already discussed these uh issues with the contractor several times. That was the best number we could get at that time, but we were continuing to work. Uh [1:21:48, 1:21:55]: He has now given us a complete breakdown of all his costs associated with the ones we thought had a little uh fat in them. [1:21:56, 1:22:16]: Excuse me. And uh that out of that we did uh were able to trim fifty one thousand five hundred and forty six dollars and nineteen cents. And we feel that uh this is a fair and equitable uh change order at this time for just over the three quarter million to do the uh parking lots and the improvements. [1:22:16, 1:22:21]: uh to uh Lee Street all the way to Bryant and coming into the amphitheater entranceway. [1:22:23, 1:22:27]: Okay. Any questions, Council, for Mr. Leighton or Deus? [1:22:29, 1:22:49]: Yeah, yeah, go right, please. I just wanna thank you guys for going back and getting that skimmed for us and making sure that we got the answers that we needed. Um I appreciate Adam actually speaking to that um at the last meeting. So fifty one thousand it is is to me a big deal. Oh yeah and so it's uh great savings and I I would like to [1:22:49, 1:22:51]: To make a motion to approve. [1:22:51, 1:23:11]: Okay, is there a second to the motion? Second. Okay, good any further discussion? If not all I would like to ask a question. Okay, go ahead. So what's the timetable look like in terms of us uh uh moving these forward? Uh and then Mr. Aaron, if you could give us a update for the public uh point of view on East Atlanta, uh what [1:23:11, 1:23:31]: What does that look like moving these projects forward? Well we'll put together the change order immediately if the council approves and uh give it to the contractor for execution. The city has to execute it and then we expect them to go to work on these right away. They're as you know, they're still being sorta held up by Georgia Power on uh [1:23:31, 1:23:42]: uh Lee and East Atlanta. Uh we have all the easements, but we don't have the easements, if that makes any sense. Uh the last easement that was needed was the uh First Baptist Church. [1:23:43, 1:24:03]: The attorney, uh Miss uh Angie Robinson, had gotten that easement, but Georgia Power needed an easement from the same people. So uh in an effort to try and speed the process up, she had us revisit our exhibits and include Georgia Power into those, and she went back to have negotiations with the [1:24:03, 1:24:11]: with them to try and get, you know, it all under one umbrella. We don't know where the status is on that right now. If we should hear something in the next week or so. [1:24:12, 1:24:13]: Mm-hmm. [1:24:13, 1:24:14]: Thank you. [1:24:14, 1:24:21]: Motion's been made by second. All favor of motion, please indicate. Thank you. Congratulate. Thank you, gentlemen. All right. Thank you, Council. [1:24:23, 1:24:30]: Council consideration to amend amphitheater policy to create a non-compete clause for private events and concerts. [1:24:31, 1:24:39]: Concerts and provide uh for revenue sharing uh for profit events. For profit events. Mr. Gardner, please. [1:24:41, 1:24:41]: Mm. [1:24:47, 1:25:07]: I I apologize for messing up the the the danger bell that bad. Um hopefully the city clerk could help me out fix it. All right, um mayor council, um obviously we brought this to you guys earlier this summer to move forward on a comprehensive policy for the use of the amphitheater. [1:25:07, 1:25:15]: And one of the areas where we realized that we potentially had a conflict as it relates to potential c competition. [1:25:15, 1:25:35]: Um with the city and its cities venue management um around the use of the amphitheater um came came to a head. Um thank you that obviously that deal did not go through, but we have made some amendments um to the document on page five. [1:25:35, 1:25:42]: If you can find that, and it's around the cost per hour for the use of the amphitheater. [1:25:43, 1:25:50]: Uh the cost and at the bottom under commerci under commercial and for profit events. [1:25:52, 1:26:06]: And that the Incle has reviewed these and felt comfortable with'em. But we also made another amendment in there that if we do have a concert that not only do we get the ten thousand, but we get the ten thousand plus twenty percent. Um so in that first um [1:26:07, 1:26:17]: bullet point where it says open to public where the primary objective is making a profit. We put in there, however, no commercial [1:26:17, 1:26:19]: All for profit event. [1:26:20, 1:26:33]: All concert shall be allowed in the amphitheater. That means that we're not allowing any commercial any other entity, like another promotion company that could come in and want to bring a slate of of uh artists to the amphitheater. [1:26:33, 1:26:46]: Whereby paying us ten thousand dollars and then walking out of the door with potentially a hundred to two hundred thousand in profits at the gate,'cause they'll be controlling the fee at that point. That won't happen, um, under this provision. [1:26:49, 1:27:00]: And where we do have a fork bushel project that's other than a competing type concert that they charge, we will get a share of the box at twenty percent. They'll take eighty. [1:27:01, 1:27:02]: Plus to ten thousand. [1:27:03, 1:27:03]: that we would get in home. [1:27:04, 1:27:06]: Yes, ma'am. All right, Ms. Gantt do you have a question? [1:27:06, 1:27:07]: I do. [1:27:07, 1:27:08]: Okay. [1:27:10, 1:27:17]: So are you saying that this purpose is for non profit? Because I said for profit. Okay. For profit. But [1:27:17, 1:27:20]: It says in red, having no commercial for profit event. [1:27:21, 1:27:36]: Or concerts shall be allowed in the amphitheater. So we're making sure that I wanna be clear that no other entity can have concerts here. No, we're not allowed for any promotion, any and it typically when they do it it would be a [1:27:37, 1:27:39]: Let's say a third party promoter. [1:27:39, 1:27:45]: that comes in with a slate of artists, you know, Ford, Gantt, Alexander Barber that's gonna come in. [1:27:46, 1:27:51]: And they're gonna rent it from us under the old provision, they would have paid us ten thousand dollars, rented the amphitheater. [1:27:51, 1:27:52]: Go out there promote it. [1:27:53, 1:28:02]: And then they could have potentially made two hundred, three hundred thousand dollars in profit. We only made ten and they could have competed or locked out potential artists that we were looking to get. [1:28:03, 1:28:16]: Um that won't happen under this. We won't lease it to anybody who's doing a for profit, a for profit promoter coming in to r to release the amphitheater would not be able to do that under this provision. I understand that your example [1:28:16, 1:28:17]: But [1:28:17, 1:28:22]: Based off of what you're saying, it sounds like we're still allowing for other [1:28:22, 1:28:28]: Entities to have concerts here. Not not concerts. So let's say I wanted to come in and do a play. [1:28:29, 1:28:31]: And I wanted to charge for a plea. [1:28:31, 1:28:37]: That's not a concert. So we would uh so Bell Ethnic if you're familiar with Bell Ethnic. And then we would split the profits on that. [1:28:37, 1:28:45]: So benefic so they come in and they want to do the nutcrocker and some other stuff during Christmas. Correct. Right? Whatever they char we they release it from us for ten. [1:28:46, 1:28:48]: Right. And then whatever their ticket box is. [1:28:48, 1:28:53]: Whatever they make, we get ten percent of our ticket box. They did d twenty percent, they get eighty. [1:28:53, 1:28:54]: Okay. [1:28:56, 1:28:56]: Okay. [1:28:57, 1:29:00]: Any other questions? Ms. Uh Ms. Barber, go ahead please. [1:29:01, 1:29:05]: I'm not sure I understand. Help me. Um [1:29:05, 1:29:08]: So if someone wanted to do a comedy show. [1:29:08, 1:29:08]: Okay. [1:29:09, 1:29:13]: Same thing. So if they want to do a comedy show, which is naughty, [1:29:14, 1:29:29]: concert that competes against whoever our venue person is or us are doing a concert, which you ours are typically free. When we host them, they're free. But our venue person that's overseeing the amphitheater, if he brings in some acts, [1:29:29, 1:29:42]: Obviously because he's not doing comedy, that will be a non that that's not a competitive issue. So they will be able to allow to lease the amphitheater at ten thousand dollars and give us twenty percent of whatever the box. So let's say they brought in [1:29:44, 1:29:45]: Ricky smiley. [1:29:45, 1:29:46]: Right. [1:29:46, 1:29:49]: And a Ricky Smiley comes in and do a concert. [1:29:49, 1:29:52]: And it's done by somebody else or Ricky Smiley promotions. [1:29:53, 1:29:53]: Right. [1:29:53, 1:29:55]: Ricky Lepeyos ten. [1:29:56, 1:30:00]: thousand to use it and then give us twenty percent of whatever that box fee would be. [1:30:00, 1:30:11]: 'Cause he's not a concert, he's not an a uh performing act per se, in terms of a concert, because that's where our venue management releases for act, recording artists. [1:30:12, 1:30:13]: Which is different from a comedy show. [1:30:14, 1:30:15]: Different from a biasia. [1:30:16, 1:30:17]: So they would be able to do it. [1:30:22, 1:30:31]: So a comedy show starring Ricky Ricky Smiley? Yes. A third party promoter promoting Ort Ren and Fire? No. [1:30:34, 1:30:34]: See the difference? [1:30:36, 1:30:40]: So what if someone wanted to do a co gospel concert then? [1:30:40, 1:30:42]: They want to do a gospel concert. [1:30:42, 1:30:44]: And they have connections. [1:30:45, 1:30:47]: of artists to do the gospel concert. [1:30:47, 1:30:56]: If that if if they're doing it for profit and it is competitive against what what our venue manager is doing, no. That's considered a concert, that's a no no. [1:31:00, 1:31:02]: So there's no way for us to [1:31:02, 1:31:19]: Partner or And here's why. I mean if if our venue person is bringing in a gospel or a couple of gossip black under the next year series, we wouldn't want someone competing against him and w um competing against us. So hence the answer to that would be no. [1:31:21, 1:31:24]: Because that could potentially be a third party R and B [1:31:25, 1:31:27]: Productions, bringing on [1:31:28, 1:31:48]: Mary Mary and um I I don't really listen to gospel music I couldn't tell you. But you can But they could partner with the city of Stockbridge. Now if they're partnering with the city of Stockbridge, that's a different issue. Okay. Yeah. That's a different this is this is dealing solely for any for profit event. Okay, not city. [1:31:48, 1:31:56]: In conjunction with RB to bring in Kirk Franklin and Merritt. That's a whole different ballgame. Gotcha. Thank you. Yes, ma'am. [1:31:57, 1:32:17]: Go ahead, sir. You did? Yeah, okay, for clarification, we've had fraternities and sorority, which are non-profits, they're not profit. They might hold a fundraiser. I think we had us sorority hold a fund table with Anthony David for example. So how would that um work? [1:32:17, 1:32:37]: under this where they would be able to come in, they would hold their fundraiser as a nonprofit with uh with an artist because that has happened here. So they they would fall up underneath that category at the top of the page if they're non profit uh non profit benefit concert, they'll fall underneath that category. I'm sorry, I don't have Tom what it what are the terms on that again? [1:32:37, 1:32:41]: Twenty five hundred. So it's on the city. [1:32:42, 1:32:48]: So on page five. Okay. So on page five of the uh agenda item number eight. [1:32:54, 1:33:03]: Okay, so so there's no matching percentage for them. No. And that could potentially be a concert. [1:33:04, 1:33:06]: Um no [1:33:06, 1:33:10]: If they're if they're not charging anybody to get in [1:33:10, 1:33:30]: That's not considered a a for profit event. So it's like the city hosting an event. If they come in and they want to do a free event, they're allowed to do that. If they want to do a for profit concert to bring in artists, they're not allowed, even if they're not profitable. But but there's a difference. See you can hold a fundraiser and you can charge [1:33:30, 1:33:50]: for the fundraiser, but it's not going to profit with non profit organizations. It's going to fundraising. It's not for profit. Right. So I'm not going to be able to do under the legal lease they are five oh one C three or what have you. So the sororities and fraternities are five oh one C three. So under this they would pay that flat two hundred and [1:33:50, 1:33:55]: uh twenty five hundred but we won't get a share of any of any of the proceeds. [1:33:55, 1:33:57]: But will they be able to charge admission? [1:33:58, 1:33:59]: Well [1:33:59, 1:34:02]: I mean, that's how they're gonna make their money, is they're gonna have to charge mission. [1:34:04, 1:34:23]: But again, again, the the definition that you're using of for profit is not necessarily inconcise with what a non profit is, because we non profits hold fundraisers where they charge for admittance all the time. Right. So under under under bullet point number four, you see where it says admission or entry fee may be charged? [1:34:23, 1:34:24]: So they're allowed to charge. [1:34:26, 1:34:42]: If they're not if they're doing it as a benefit event and they're not walking off of the with the proceeds. Okay, so okay. So they would be able to charge. They can charge, yes. Okay. Okay. And I and and I will tell you we will always wanna make sure that whatever they're doing is not in competition with us'cause if it is, then we won't let'em. [1:34:42, 1:34:45]: 'Cause our goal is not to compete against ourselves. [1:34:46, 1:34:47]: Certainly. Yep. [1:34:48, 1:34:57]: If it's a are you saying that non profits can have concerts? I mean they might. I mean they might wanna like she said they might wanna do let's say [1:34:57, 1:35:01]: A church wanna do a gospel thing, but it's going towards [1:35:01, 1:35:08]: Hinds of hope hands of hope. There is one hundred percent is going to a charity, then it's not for a profit event. [1:35:09, 1:35:13]: As long as they're not competing against any of our artists or locking out any of our potential artists. [1:35:14, 1:35:15]: They should be fine. [1:35:16, 1:35:25]: How do you measure that though? How would you be because when they apply as part of the application, they need to let us know what they're doing in the application? [1:35:25, 1:35:27]: And we get to review that application and say yay or nay. [1:35:28, 1:35:29]: So [1:35:30, 1:35:32]: I probably would much rather [1:35:33, 1:35:37]: To me it's still gonna be a little messy. I would prefer [1:35:38, 1:35:47]: in general, if it's a if it's a any type of concert, they would have anybody would have to partner with Startbridge. If it was a concert [1:35:47, 1:36:05]: If there's somebody that wanted to do a concert, I feel like they would have to partner with Stockbridge. I don't think I think it would be a little cloudy and uh, you know, messy trying to determine, okay, this artist uh hey, Stockbridge, are we doing this artist? No. [1:36:05, 1:36:10]: You have to if you want to have any type of concert, you're gonna partner with Stockbridge. [1:36:11, 1:36:28]: And the other type of shows and acts and balls or whatever, like uh my sorority, we do wine tasting event or whatever that case may be. We might have a now we don't do that anymore. But they are interested, I know. Mm aka's by the way. And um [1:36:30, 1:36:35]: You know, for scholarships or whatever the case may be, then fine, so be it. But if it's a concert [1:36:36, 1:36:37]: Then they have to partner. [1:36:38, 1:36:39]: With Stockbridge. [1:36:40, 1:36:41]: But the [1:36:41, 1:36:43]: I just think that makes sense. [1:36:44, 1:37:04]: The the reason that I say that is because we actually had that happen where a provider came to us, one of the sororities, then they ended up going to McDonough because they we didn't have that option available to them. Where they had I mean, the profit margin for them was very slim. So they really if they split the profit they really weren't gonna be making any money. So [1:37:04, 1:37:24]: i these margins are very slim. So I it was a special situation where they came to us, they went I want to call them the f the sorority out, but they did uh come to us and then there was a profit arrangement and there was w they they weren't able to work that out. Yeah. I get it. And and and mind you, I mean [1:37:24, 1:37:36]: you're we're not gonna write something to gonna catch every potential issue, but to address what you were saying as it relates to a nonprofit benefit event, um, any mus any musical event. [1:37:36, 1:37:40]: Tell me what you think about this. Any musical event shall require a partnership [1:37:40, 1:37:43]: Um an approval by the city of Stockbridge. [1:37:43, 1:37:47]: Correct. We could put that billet point in there. That would aunt that would address what you just mentioned. [1:37:47, 1:37:48]: Councilmember Gamer. [1:37:49, 1:37:51]: Yes. So we'll make we'll make that we'll make that note. [1:37:54, 1:38:04]: Yes, ma'am. Um any mus any mu uh I should say any musical event shall require a partnership and agreement with the city of of Stockbridge. [1:38:04, 1:38:04]: Correct. [1:38:07, 1:38:17]: So you got you guys get the they get to come before you tell you tell us exactly what they wanna do and partnership with us and what that partnership would look like. You guys get to approve those that come before you. [1:38:17, 1:38:25]: Okay. In terms of that. So that's that way it's not left up to staff to determine whether that's a good or bad partnership to get you guys get to vet it. [1:38:28, 1:38:29]: Any other comments? [1:38:29, 1:38:40]: So I was am I assuming I'm sorry, you got no comment? Yeah, I am curious about the expenses. Um, so for even the non profits that wanna do like a a play. [1:38:41, 1:38:43]: The expenses um [1:38:43, 1:38:46]: Sounds, lighting, chairs, tables. [1:38:46, 1:38:47]: Um [1:38:48, 1:38:53]: That is included in this rental agreement. [1:38:53, 1:38:55]: Bullet point. [1:38:57, 1:39:09]: Under bullet point seven, the second to the last, any cost for services provided by and incurred by the city of Stockbridge for the operations of the event must be paid. [1:39:10, 1:39:17]: So we have to do any any special consideration, lights, all of that. They gotta pay us to do it. They pay for it, not us. [1:39:18, 1:39:36]: Um so does all events require security? Yes. As well. That's in here as well. Yes, ma'am. All events require insurance. If you liability insurance. Okay, so if you turn over to page number six. [1:39:38, 1:39:42]: It lays out um the coordinated services. [1:39:46, 1:39:55]: And in there it lays out um paid details um for um public safety in there. [1:39:56, 1:39:57]: And [1:40:02, 1:40:15]: There's another provision in there that based on the number of hours with those what based on the size of the event, there's another pro portion in the con in the agre in the policy that based on the size of the event will dictate how much public safety officials you need. [1:40:15, 1:40:20]: So the larger the event, the more public safety officials you need to pay for to be at that event. [1:40:21, 1:40:24]: Well I'm seeing here, um, it says [1:40:25, 1:40:25]: Um [1:40:26, 1:40:34]: Certain services shall be provided by the city or its authorized agents, with the agent, with the applicant reimbursing the city. [1:40:36, 1:40:40]: I don't think it's a good idea for us to pay up front costs. [1:40:40, 1:40:41]: For [1:40:41, 1:40:45]: any entity that wants to rent the amphitheater. [1:40:45, 1:40:49]: It is their responsibility to provide for [1:40:49, 1:40:51]: All these services up front. [1:40:54, 1:40:54]: Agree. [1:40:57, 1:41:05]: Whether they pay a deposit that will cover the cost of janitorial concessions. [1:41:05, 1:41:06]: Security. [1:41:07, 1:41:08]: We shouldn't [1:41:09, 1:41:12]: Bear the burden of paying the cost up front. [1:41:13, 1:41:13]: That is on. [1:41:14, 1:41:17]: That's the responsibility of the person who's renting it. [1:41:17, 1:41:21]: That's just my thought. Well and and I think it it [1:41:22, 1:41:42]: Just saying, you know, that's certain certain things we'll do that for. So in essence, like with the one we just did just now, where we made the amendment for a partnership. Well in that circumstances, yes, we might do the upfront course on certain things on lighting and sound if we're in partnership and you guys agree to it, then that would meet the requirement. [1:41:42, 1:41:47]: 'Cause it it it's it's kind of open ended to allow for us to be able to look at because it says um [1:41:50, 1:41:51]: Where was that again? [1:41:54, 1:42:14]: It says um to best serve our guests and to maintain continu um integrity of the amplitude, it is the policy of the city that certain services shall be provided by the city or its authorized agent with the applicant reimbursing a city fall cost. So certain these is open to say if it's [1:42:14, 1:42:29]: It's a partnership or something to that effect, then we could look at that and say whether or not we would do those costs. Otherwise typically they'll put they'll be paying for them in reimbursing. [1:42:29, 1:42:32]: Пиказ івенфорправит івент. [1:42:32, 1:42:33]: I don't want [1:42:34, 1:42:37]: those who may be interested in renting the amphitheater. [1:42:37, 1:42:40]: To assume the city will pay for the cost of [1:42:40, 1:42:41]: Clean up and [1:42:42, 1:42:44]: Tables and chairs. On page three. [1:42:45, 1:42:49]: Page three. Yep, top page uh and top um B. [1:42:53, 1:43:13]: Says applicants shall pay for talent, sound lights, stage hands, publicity, advertisement, backstage catering, events, security, medical services, ASCAP, BMI, transportation, trash removal, equipment to include a bucket lift, portable lighting, fencing, and barricades, telephones, events, maintenance, crowd sanitation, runners, personnel and services necessary for the efficient and safe. [1:43:13, 1:43:19]: presentation of events at the amphitheater. But I guess, and I I agree with Councilwoman Barber. [1:43:19, 1:43:35]: We need to make sure it's consistent. I don't I don't think uh yeah. I think that, you know, that can be confusing. What if there's something else that needs to be added in? Why don't we include what our rental is on our side? So I would prefer to say [1:43:36, 1:43:42]: Something like your rental includes the amphitheater, everything else is on you. [1:43:43, 1:43:52]: Uh uh a coup the point that I want to make. I mean if that's what we're gonna do. That's what I'm saying. If that's what's included. If it's if we include if we're including [1:43:52, 1:44:01]: as part of their rental agreement, other additional services, fine. But it needs to be spelled out in that manner. Yes. And I think that it would be um [1:44:02, 1:44:03]: Um [1:44:03, 1:44:11]: I I think it would be advantageous for us to do it in that way because we're showing what services we provide versus what services they're responsible for. [1:44:11, 1:44:12]: I agree. [1:44:15, 1:44:35]: Sir. Go right ahead, please. The only concern that I have with that is that do we just want Fortune five hundred companies coming in or large companies? What about a small business that wants to get started? You're putting the money up front so they can pay you back through the ticket sales. If you do not do that, then you're gonna limit it to [1:44:35, 1:44:55]: deep pocketed individuals or or businesses that can come in and do this, but the small business person is gonna be cut out because they can't they don't have the upfront capital in order to do all these expenditures. They count on the money to come back on the back end. So what you're doing is uh how a business [1:44:54, 1:45:02]: Would operate, you're gonna exclude a lot of small businesses because they're not gonna have upfront capital to do what you're asking them to do. [1:45:03, 1:45:11]: I understand. Go right ahead, please. I understand that, but so then perhaps um [1:45:11, 1:45:31]: They just don't have the financial wherewithal to put on a concert if they can't bear the burden of the cost of the expenses. Well it's not just gonna be just a concert. It's gonna be a lot of these events where they're gonna need to bring in the ticket revenue to reimburse the city, otherwise they're not gonna be able to do the event. But so for some of those entities that want to host [1:45:31, 1:45:32]: Stay. [1:45:32, 1:45:34]: show concert. [1:45:35, 1:45:36]: Whatever it may be. [1:45:36, 1:45:37]: Mm-hmm. [1:45:37, 1:45:39]: Even if it's a non profit. [1:45:40, 1:45:42]: Who's not selling tickets? [1:45:43, 1:45:49]: I don't want them to assume that the city is going to bear the cost. Oh no, oh no, they w we will [1:45:49, 1:45:52]: For security, for lighting. [1:45:52, 1:46:01]: We're not going to do that. Well I'm not we want our money back. But certainly we want the money back. No, I don't want to put any money up front. [1:46:01, 1:46:21]: At all. But again, as I said, if you don't do that, you're cutting out the small business person. They're not gonna be able they don't have that type of upfront capital in order to make that happen. That would be my concern. Right, but it the language that he said it was [1:46:21, 1:46:41]: Especially it would be well read the language again that's in there. Which one you said it would be a s diff circumstances or something you said? Um and and remember even under B, um it it says shall. So there isn't a shall is a i is a action that says you there is no ambiguity with the word shall. [1:46:41, 1:46:42]: Shaw means you will. [1:46:43, 1:46:52]: It doesn't say you might have to pay f have to shall y it doesn't say applicant might pay for talent so fort lights, all of that. It says they shall pay for those. [1:46:53, 1:47:03]: um if they use it in the venue. Um as it relates to it the section ten, coordination of services, um, it says here to best serve [1:47:03, 1:47:09]: to best serve its guests and to maintain the integrity of the amphitheater ump the amphitheater facility. [1:47:10, 1:47:28]: it is the policy of the city city of Stockbridge that certain services shall be provided by the city or its authorized agent, with the applicant reimbursing the city for all costs associated with the provisions of such services. So [1:47:29, 1:47:37]: You know, that that is that allows for in a simple case there where we could do something to help that small business or whatever. [1:47:38, 1:47:42]: You know, i it it gives some some leeway of discretion, but then again [1:47:43, 1:47:48]: You know. I don't like that at all. I think it's a conflict with B. I I actually think that [1:47:49, 1:47:50]: What we would do is [1:47:51, 1:47:51]: Um [1:47:51, 1:47:52]: Councilman Alexander. [1:47:53, 1:48:03]: Sounds like they would want to be in a partnership again because I'm not willing. I haven't met there is not one venue, a ballroom or anywhere where you go and they say [1:48:04, 1:48:17]: Oh, you know what, we're gonna take care of this for you and we'll see whether or not you're gonna get some we'll we don't know if your chick what your ticket sales are and we'll get your money back. No, you don't do that. You uh never have I seen or have I rented anything. [1:48:18, 1:48:19]: And they say [1:48:20, 1:48:32]: Okay. Y you're responsible for cleanup, but I tell you what, since you don't have the money, we're gonna go ahead and clean it up and when you get your money you pay us back. No saying out of ticket sales that night. Yeah, but I'm saying you don't [1:48:33, 1:48:34]: The amphitheater. [1:48:34, 1:48:38]: To me, and this may be different for everyone else. [1:48:39, 1:48:59]: We invested twenty-five million dollars in a state of art building. Mm-hmm. I think that it deserves the class and respect and eliteness that it deserves. Now that does not mean what I'm saying is But a small business purpose should never be cut out. I'm not trying to cut out a small business person. [1:48:59, 1:49:19]: They may not need lights. They may not need sec what but if you can't afford to pay for to be cleaned up, then you don't need to be here because this is not that place. Go to the Mermanders. I'm sorry, you this is you have to have certain limits. The amphitheater is huge, it sees 3,500 people. If you can feel that [1:49:19, 1:49:32]: place with 3500 people, then you can pay for these amenity the things that are required to do it. I have you have to be strategic about it. I can't support otherwise because you look at it. [1:49:33, 1:49:33]: Here. [1:49:34, 1:49:54]: There will the nonprofit is paying twenty five hundred dollars. Mm-hmm. If they have a fundraiser, let's say they rented the green room, they had a fundraiser, or they rented out the front part up here and they twenty five hundred dollars. All they need is security. They're not having the just like that event the other day, um, with the chamber. [1:49:54, 1:50:01]: And all of the above. That's we're not gonna pay for it and then say it'll pay us back. We're not in the m business of lending money. [1:50:01, 1:50:21]: I'm not saying any of that. What I'm saying to you is that all you're doing basically you can you're eliminating the small business person. There's no nonprofit in this area gonna be able to use the amphitheater. Not one. I'm a small business. I can't afford the amphitheater right now. And guess what? It's okay. It's okay, cause I'm gonna do what I gotta do for I will [1:50:21, 1:50:32]: I would love to do that for my business, but you cannot do that. It's unreasonable. Mr. Gardner, you have something you need to answer? Ready? Let me know what you're what you guys think. So [1:50:33, 1:50:37]: First remember I think uh the the last sentence in there says services may [1:50:38, 1:50:38]: Include [1:50:39, 1:50:59]: Um but not limited to the following. So obviously if we don't want to put lighting in there, then we need to get rid of the not limited and it shall include only these services that we would would assist on, right? So lighting and sound goes out the door because those are probably the most expensive side of the house. Right? So it takes that option off the table. We can also make an amendment. [1:50:59, 1:51:06]: Where it says to the best to best service guests and to maintain the integrity of the amphitheater facilities. [1:51:07, 1:51:09]: It is the policy of the city of Stockbridge. [1:51:10, 1:51:14]: That when in partnership with a non profit entity. [1:51:14, 1:51:34]: Um, these services shall be provided by the city or its authorized agent in conjunction, I mean with the applicant reimbursing the city for all costs associated. So, once again, that's something that would come before this body to look at and approve, nothing administrative, because any partnership has [1:51:34, 1:51:41]: has to be approved by council. Pardon. So that would give you guys an opportunity to review and make the exceptions. [1:51:42, 1:51:48]: Okay. That could be for a partnership. I could get that. But what I do not it sounds like to me [1:51:48, 1:51:52]: You know, uh if you go to a hotel room and you say, Hey [1:51:53, 1:52:05]: You broke the T V. Your kids were bad. They knocked'em down. Then guess what? You're gonna have to pay that back. So that's what the clause is really supposed to say. It's not saying it correctly, but that's what it's supposed to say. [1:52:06, 1:52:10]: Um basically if you tear up something, you're gonna be responsible for it. [1:52:10, 1:52:15]: That's it. But I think that I get what you're saying in regards to I think [1:52:16, 1:52:20]: When you say, Oh, would you be responsible for paying for lighting or something of that nature? [1:52:20, 1:52:22]: I don't think you have to take out that. I think that [1:52:23, 1:52:43]: What we're saying is it only applies to the partnerships. Correct. And and that's something that's approved by this council. Okay. So that's what it takes. So that takes it wholly out of the administrative review. It comes any partnership comes to you. So they are asking for any exceptions. You guys get to look at it and say yes or no, or we could do or we can't. [1:52:43, 1:52:50]: That's fair enough. And that'll be part of the negotiation box. Alright. So otherwise you [1:52:50, 1:52:53]: You were gonna t change Mr. Gardner? [1:52:54, 1:52:56]: You can make it you're making those appropriate [1:52:59, 1:53:05]: Um that's being inserted right after this policy of the city of Stockbridge. [1:53:08, 1:53:10]: Page number six, number ten. [1:53:11, 1:53:12]: Yes, ma'am. [1:53:14, 1:53:22]: So you're making those particular changes, so Yeah, we'll make those we'll make those and go for it once adopted with those. But how many total changes have we made today? [1:53:22, 1:53:26]: Uh section ten, as amended in section ten. [1:53:34, 1:53:36]: Yeah. [1:53:37, 1:53:38]: From the oath. [1:53:46, 1:53:50]: Page five, non profit benefit events, non concert. [1:53:52, 1:53:55]: Coach number it's just a partnership. [1:53:56, 1:54:03]: Yes. And then page number five. Under non profit. That's where we made an amendment. [1:54:07, 1:54:15]: Yes. Goes there and then everything else stays the same. I want to make sure that whatever we agreed to [1:54:15, 1:54:27]: You understand, Mr. Gardner, for the change and the clerk has that properly. Cause my assumption is if that's the case, then we're gonna have a motion to accept this particular change. These changes. Is that correct? Yeah. [1:54:32, 1:54:34]: So y so there's change on page five. [1:54:35, 1:54:38]: under non under non profit benefit events. [1:54:39, 1:54:44]: And then there's a change on page number three. [1:54:48, 1:54:49]: Oh, what was that? Nope. [1:54:58, 1:55:05]: On page number six, section ten, coordination of services, exclusive services. [1:55:14, 1:55:22]: Yeah. And um Mr. Lander, um Councilmember Lander, page nine lays out the liability. [1:55:24, 1:55:26]: А стов концерн реберси. [1:55:27, 1:55:29]: The city for services. [1:55:29, 1:55:33]: Unless it's a partnership. That's that's the only time in in Vilha. [1:55:34, 1:55:51]: Okay. So we're gonna reword. Or we'll put that? Approve with notes. So then all we gotta do is change it and then update the update the website and uh print the documents. Okay. Are you asking us to approve this? Yes, ma'am. So yeah, so we can move forward. So yes, ma'am. [1:55:52, 1:55:55]: Okay. Thank you. Yes, ma'am. [1:55:56, 1:56:01]: No. No no no. I was just illustrating the the liability insurance requirements. [1:56:04, 1:56:06]: So if I got it right, it's only three changes we're making? [1:56:08, 1:56:08]: Two, sir. [1:56:09, 1:56:10]: Two. [1:56:11, 1:56:17]: All right. So we got two changes and the council is in agreement. So is there a motion on the floor to accept these changes? [1:56:19, 1:56:20]: Mayor. Yes, Mayor. [1:56:20, 1:56:24]: I move that we accept the changes with the um [1:56:25, 1:56:26]: In regards to the [1:56:26, 1:56:29]: Amphitheater con rental contract agreement. [1:56:30, 1:56:33]: To include those things that we amended. [1:56:33, 1:56:35]: One um [1:56:35, 1:56:38]: was that for non profits [1:56:38, 1:56:43]: If they want to have a concert, they would have to partner with the city of Stockbridge. [1:56:43, 1:56:47]: and all partnerships must come before Mayor and Council. For approval, [1:56:48, 1:56:50]: Okay, is there a second? [1:56:50, 1:56:52]: So [1:56:53, 1:56:53]: Um [1:56:55, 1:56:56]: So did you [1:56:57, 1:57:08]: To both of those conditions that we talked about? Yeah. Oh and all okay, that's right. And all I'm sorry, let me amend let me change that. All [1:57:08, 1:57:12]: may come all must come before any partnership. [1:57:14, 1:57:17]: must come before mayor and council for approval, [1:57:18, 1:57:22]: And that includ and and all partnerships [1:57:23, 1:57:27]: include the reimb well I don't think we have to do that because all partnerships include we don't have to do that. [1:57:28, 1:57:31]: [7051.9, 7053.8]: does not tie the city or [1:57:34, 1:57:35]: Include the city. [1:57:36, 1:57:36]: And any [1:57:37, 1:57:38]: Actions of [1:57:38, 1:57:42]: the applicant having to reimburse us for anything. [1:57:42, 1:57:48]: They should be able to pay for all those services up front. So if we could remove [1:57:48, 1:57:51]: That sentence reimbursing the city? [1:57:51, 1:58:04]: For all costs associated with such services. But that's what we had agreed upon is that it would be a partnership. But there were certain services excluding the lighting and all of that. But we need to remove [1:58:05, 1:58:25]: Well well we would add that it must be as a in order to in order for us to do something like that it have to be parts partnership. I don't know how we would change the wording, but it has to it has to state partnership and I get what you're saying, Councilman Robert. Um Do we have legal to help us? [1:58:25, 1:58:25]: That's what this. [1:58:28, 1:58:48]: We we're simply trying to help the And I I believe that uh Mr. Garner may have to come back to the podium as well to get this finalized if Mr Mr. Washington is coming forward to be responsible for upfront cost of any entity that wants use of the amphitheater. [1:58:48, 1:58:58]: I know what he said, but I'm reading this policy and I want to make sure that the language is consistent with what he's saying. Okay. [1:59:01, 1:59:07]: Good evening, Mayor and Council. I think the easiest way if you want to incorporate that comment is just to say that the city will not pay any upfront costs. [1:59:08, 1:59:09]: And then we'll reflect that in a document. [1:59:10, 1:59:11]: Thank you. Okay. [1:59:13, 1:59:14]: Is that acceptable for the rest of the council? [1:59:15, 1:59:16]: That's acceptable. [1:59:16, 1:59:20]: Okay, so uh so we know exactly where that's gonna be placed in the document? [1:59:22, 1:59:40]: And if that's the case, then I guess we need a motion to accept these particular changes. Revise the motion. My only question is we we got a spent we got an event already that we're working on that's gonna be rescheduled for next year. That includes reimbursable funds up front. So we're not gonna do the event. [1:59:41, 1:59:47]: That event needs to come back to this can be a little bit more than a little bit. [1:59:49, 1:59:50]: Well, um okay, I'm sorry. [1:59:53, 1:59:54]: So the city will not [1:59:56, 2:00:00]: The the applicant is responsible for any upfront cost. [2:00:02, 2:00:07]: unless or w unless the council approves otherwise. [2:00:09, 2:00:11]: Because it still has to come before council. [2:00:15, 2:00:25]: All right. Unless co council approves otherwise and that's for our partnerships. Uh I I'm okay with that, but in the end if there's no they're they're gonna cancel the concert if we don't. [2:00:25, 2:00:32]: But if that's the where we are. But if that's the desire of the council. It didn't Oh I d I'm not talking about that particular. That's not my desire. [2:00:32, 2:00:39]: I know, but that's that's the end result. No, I'm saying unless counsel states otherwise, we've already uh well, [2:00:42, 2:00:55]: I thought we've already had I thought th I think that's old. This is something new. This is our new policy. I think they're grandfathered in. Going forward. Right. Unless council approves it. So what I'm saying is [2:00:55, 2:01:08]: If someone needs to if they're gonna partner with us, we're gonna approve it and we may say, Okay, we got the lights, we got this, you handle this, you handle that. But otherwise w we can't that's the best way to do this, I think. [2:01:11, 2:01:14]: Mr Gardner, need you back at the podium, sir. [2:01:14, 2:01:15]: Yeah. [2:01:23, 2:01:32]: See if we can work out these details here that we're talking about. Make sure we got it proper on the document there and as as gathered by the by the uh [2:01:33, 2:01:42]: The clerk and the counsel is in agreement. Now you all had further discussion in reference to some verbiage. You gotta make sure we understand what the verbiage is and where it's going. [2:01:44, 2:01:46]: So let's let's see if we can nail this down. [2:01:50, 2:01:52]: So are we eliminating section ten? [2:01:54, 2:01:58]: 'Cause if you eliminated then you don't have any you don't have to worry about any coordinated services. [2:01:58, 2:02:00]: I would agree with that. [2:02:01, 2:02:03]: I would agree that we eliminate [2:02:03, 2:02:04]: Section ten. [2:02:05, 2:02:06]: All together. [2:02:08, 2:02:13]: What do we do about the existing agreement that we have? We just tear it up. We already have an agreement. [2:02:14, 2:02:16]: Everything at this point. [2:02:16, 2:02:18]: Going forward. [2:02:18, 2:02:20]: will fall under this policy. [2:02:20, 2:02:22]: I don't know what agreements were made. [2:02:22, 2:02:23]: with the existing [2:02:24, 2:02:24]: Even [2:02:25, 2:02:29]: It didn't come to this council. I'm talking about everything from this point. [2:02:29, 2:02:30]: Going forward. [2:02:30, 2:02:46]: The city shouldn't be paying upfront cost. But unless it's a partnership. Right. Well that's we we said it all we just made that that every event going forward is going to be a partnership. That we've agreed upon that. We're talking about a partnership. That's what we're talking about. [2:02:50, 2:03:06]: Every event going forward will be a partnership with the language uh as described to make to make sure that these uh there are some expenses that can be reimbursed, but as these as Councilwoman Gantt said, they would have to come back to us for any partnership anyway. [2:03:08, 2:03:09]: Is that correct? [2:03:10, 2:03:18]: Yes, that's correct. They have to come to us for our uh if we're having a partnership agreement, they would have to come to us and that's way we can work out the logistics of that. [2:03:18, 2:03:38]: Right. And any other events if if this if you eliminate this provision, then you don't have to worry about any other type events that come in that might say, hey, can y'all do XYZ? We say no because we don't have any requirements. Okay, let's move forward. Mayor Ford, I'd like to make a motion. Or Councilwoman Gat, your motion is still on the floor. [2:03:38, 2:03:42]: The motion that you you originally made was it seconded? Yeah. Or did you did you amend it? [2:03:43, 2:03:47]: Ms. Geth. I I amended it. Can you amend your motion? Sure. To eliminate [2:03:48, 2:03:49]: Number ten. [2:03:49, 2:03:53]: Of the policy. Okay. Look at that. [2:04:00, 2:04:00]: Okay. [2:04:03, 2:04:05]: I'm I can amend my motion to include that. [2:04:06, 2:04:07]: To eliminate that. [2:04:08, 2:04:21]: What's what's your motion now? What's your motion? So my motion now is to remove policy number ten I mean statement number ten, coordinate coordination of services, um, to add on page five [2:04:24, 2:04:33]: That under nonprofit biz benefit events, that they can they cannot be concerts, non-concerts, unless they are part of a partnership. [2:04:33, 2:04:35]: With the city of Stockbridge, [2:04:40, 2:04:41]: And [2:04:41, 2:04:53]: I think that's it. All concert any concert must be oh any partnership must be brought to Mayor and Council requ upon request. [2:04:56, 2:05:12]: So we let me ask a question on that. Uh you you gotta understand what you're asking for. If there's three hundred and sixty five days in the year and somebody wants fifty people wanna come to us, that means fifty people gotta come back to us every single time. Is that what we wanna do? [2:05:13, 2:05:21]: Fifty times. We're gonna hear fifty different events. Is that our function or is that a staff function? I think it's micromanaging, but [2:05:24, 2:05:25]: [7527.0, 7528.3]: It's micromanaging. [2:05:29, 2:05:30]: To partner. [2:05:32, 2:05:52]: Well I would think if we want to partner, you would probably want to be able to have some say so I would imagine fifty fifty times the come to us fifty times. Ms. Garner, Mr. Gardner, sir. All right. So I I guess we something y'all y'all agree. I think this would this would y'all so any musical any any musical event shall require partnership [2:05:52, 2:05:55]: the city of Stockbridge and approved by the city council. [2:05:56, 2:05:56]: Correct. [2:06:00, 2:06:03]: Fine with me. Okay, I'm good with that. [2:06:05, 2:06:09]: Motion or not. No upfront thoughts. Or do I take that out? [2:06:09, 2:06:11]: Yeah. So we eliminate the section chain. [2:06:13, 2:06:14]: Got the end. [2:06:15, 2:06:18]: Mean all all sex and ten is coming out now? Yes. [2:06:25, 2:06:27]: And it's being replaced by what exactly now? [2:06:30, 2:06:42]: So that that coordinated services goes away. The only coordinated service will be under an agreement and obviously that's controlled by the partnership under agreement. You'll need a section cover. [2:06:42, 2:07:02]: So whatever they come in for and request, you guys get to see it and improve the scope of what their request is. And if it's if their request includes some coordination, y'all get to allocate or not allow at all. It's at your discretion. [2:07:02, 2:07:05]: quick. So if we eliminate ten. [2:07:07, 2:07:12]: kinda shooting ourselves because there's certain things. [2:07:12, 2:07:16]: Um, let's say we have a vendor that does the s the cleanup. [2:07:17, 2:07:34]: You know, when when you go rent to a specific uh facility, you can only have a certain caterer. It's kinda like you can only use these caterers because we know they do a good job. Preferred caterers. Preferred caterers. It's kinda just like that. We know that these are our preferred caterers. [2:07:34, 2:07:41]: concession people or these are our preferred janitorial services because they know our amphitheater. You can't just go out there and hire [2:07:42, 2:07:42]: Whoever you want. [2:07:43, 2:07:46]: So I think that's what this clause is trying to [2:07:46, 2:07:47]: Todo. [2:07:47, 2:07:50]: Із чайна мек шо да сіді. [2:07:51, 2:07:54]: Газ де он хуйю. [2:07:56, 2:08:00]: who the who the ser who who who we use. That's what clause ten is doing. [2:08:01, 2:08:07]: Trusted contractors that we know will take care of the business. We know it's gonna take care of the business. And I'm okay with that. [2:08:08, 2:08:12]: Right, but we have preferred caters and we we should. [2:08:12, 2:08:18]: Because some people might have terrible health scores or they may have um you know [2:08:18, 2:08:22]: Just different things. And so we should have preferred. I mean, I think that's normal. [2:08:24, 2:08:35]: This is not this doesn't say anything about caterers. No, no, I'm the I'm using it as an example. But I don't I don't I don't feel comfortable with the city paying upfront cost. [2:08:35, 2:08:37]: Of any shows. [2:08:38, 2:08:40]: Unless there is a partnership. [2:08:40, 2:08:43]: That we've all agreed and negotiated. [2:08:43, 2:08:52]: Whatever the services would be provided. I don't want us to advertise it as open-ended for anyone that wants to rent the amphitheater. [2:08:52, 2:08:55]: The city will pay the upfront cost. [2:08:55, 2:08:57]: And they will reimburse us. [2:08:57, 2:09:01]: I won't agree with that. Can I just ask that we table this item? [2:09:01, 2:09:02]: Yeah. [2:09:03, 2:09:23]: It seems as though w we we have not reached an agreement. No, no, no. I agree with you on that. I see what you're saying. But I would just remove the applicant reimbursing the city. I would still want them, just remove that line. The applicant's not going to reimburse the city, but the city has the right to say these are our preferred lists. You have to have a [2:09:23, 2:09:27]: prefer a list of some sort. Yes. So I agree with you on that. [2:09:27, 2:09:29]: A all the alternatives you can do. [2:09:30, 2:09:39]: to accommodate I think and this might accommodate everybody's that in order for you to have coordinated services, that it has to be part of an agreed upon [2:09:39, 2:09:49]: partnership with with the city. So therefore that that would you keep the language in here and you just put we can put [2:09:52, 2:09:54]: Take that language out. Um [2:09:55, 2:10:07]: I mean keep the services, take the language out and say uh the city has the say these are the preferred serv the city may have a list of preferred services or whatever that you're gonna utilize. [2:10:07, 2:10:18]: that you're gonna utilize these these particular companies. So but take out the language of us reimbursing the city for all costs. They have and the other one and it conflicts with the other clauses anyway. [2:10:18, 2:10:34]: Well, and unless you change it and make it as part of an agreement, then it doesn't contradict, right?'Cause you in order for you to get these cot these services, potentially, it has to be part of a of a partnership which has to be approved by council. [2:10:34, 2:10:38]: Right, so that's the only way that these provisions would ever come into play. [2:10:38, 2:10:51]: If they don't have a contract and they're coming in as a sole person wanting to use or entity wanting to use the facility, this doesn't come into play with them because there is no contract. They're either coming in as a straight non profit or a straight for profit entity. [2:10:51, 2:10:54]: The only time this comes into play is if you have a partnership. [2:10:55, 2:11:05]: And then it allow for you guys to be able to review it as part of that contr uh part of that and say, Yes, we're in conjunction with janitorial, we're not in conjunction with parking management. [2:11:05, 2:11:15]: a la cart whichever one of those you want as part of an agreement. Uh that way I think you you you get you you you you you satisfy both sides. [2:11:17, 2:11:28]: Yes. I think Miss Ms. Barber is Boston, you stepped up to the mic, so you have something to say, sir. I was just gonna say as long as everybody's clear with the numbers that we have for Quarum Nine takes three O to pass. [2:11:28, 2:11:32]: I'm sorry, say again please. With the numbers we have here tonight, it would take three to pass. [2:11:33, 2:11:38]: Yeah, I know. And so as long as everybody knows that be clear. [2:11:39, 2:11:52]: Well do y'all wanna table it? Y'all y'all wanna if y'all wanna t if if it's the w is a council we table it, we'll make these amendments and bring it back and then if you guys will let motion the table. All right. [2:11:52, 2:11:59]: We don't have anything in front of us coming to use it at this time. There's a motion on the floor to table. Mo so move. Is there a second? [2:11:59, 2:12:10]: I saw Miss Barber's hand first. Alexander Barber, all in favor, please indicate. Oh now table. All right, we'll move on. Okay. Thank you. [2:12:11, 2:12:26]: New business council consideration to approve adopted road program agreement with James E. Lacey Lodge number six hundred to adopt Campground Road from Woodbrook Drive to Highway forty two. Mr Aaron, please. [2:12:28, 2:12:48]: Yes, good evening once again, Mayor and Council. We come before you tonight. We have a group that wants to adopt a city road for uh litter pickup and maintenance. And we're coming tonight to ask for your approval. One of the reasons we want to bring all of these before Mayor and Council is that you have a say so in who are [2:12:48, 2:13:08]: Who are adopting streets and providing maintenance in the city of Stockbridge. We'll continue to tweak this policy as necessary. This will be our second group if it's approved. The first group is Stockbridge Youth Council. And so we just want Mayor and Council to always have the final say-so and whether our group [2:13:08, 2:13:10]: group or organization gets to adopt the city role. [2:13:11, 2:13:31]: Mayor. All right. Well fantastic. I I wanna I would imagine that the council approved this, but it's great that people want to do this this bit for our roads. But anyway, council. Yes, sir. Um my knowledge. Yeah, but it's up to you, sir. Yeah, I just want to say that yes, uh I have been spok um I spoken to uh the lodge and I've spoken to uh John Bailey. [2:13:31, 2:13:51]: And then uh my neighbor Rodney Joyner. Uh they came out, uh Rodney came out and actually helped uh with the campground road, keep Stark Bridge beautiful. And that's where he said, you know, is there anybody responsible for this road? And that's where the process began at. So certainly uh that would be a good asset to the city helping us maintain so [2:13:51, 2:14:00]: I make a motion to approve. I second. Ms. Bar um Barber second uh excuse Gantt second that. All favor, please indicate. I see you now. Thank you very much. [2:14:01, 2:14:08]: Council consideration to approve the award request for proposal RFP number two zero two two dash zero zero one. [2:14:08, 2:14:09]: One [2:14:10, 2:14:30]: Water control office and lab renovation services for the city of Stockbridge to diversify construction of Georgia, incorporating an amount of five hundred ninety-one thousand two hundred ninety-four dollars. Fund source water and sewer fund balance. Mr. Aaron, please. Yes, Mr. Mayor. On June 30th, 2022, the city opened three. [2:14:30, 2:14:50]: Three bids that were received were from McWright, General Contractor and Electrical, Crown Services Contractor, and Diversified Construction of Georgia Inc. On August 16, 2022, an evaluation committee met and reviewed the different proposals, but this project will update the city's wastewater treatment plant. [2:14:49, 2:15:09]: Laboratory and offices. It hasn't had any updates since 1997. So the laboratory equipment is outdated. It has far exceeded its useful life. And also, we're going to do some improvements to the facility as well, such as restrooms, showers, and things of that sort. So we're asking mayor improve and counsel. [2:15:09, 2:15:15]: Council to approve this renovation project that is greatly needed for the wastewater treatment facility. [2:15:15, 2:15:17]: All right. Council, any questions? [2:15:18, 2:15:29]: Only question I always have is does this anticipate any future growth whereas the facility might need to be expanded or anything or long is this part of the long term plan? [2:15:30, 2:15:50]: This is for office space, so we're kind of confined to that footprint and the staff will not increase substantially, so it will be useful far into the next fifteen and twenty years as we will be renovating a former former laboratory as well to include additional spaces and storage space for staff. [2:15:51, 2:15:53]: Any other questions for the council? [2:15:54, 2:15:56]: Need a motion to accept this proposal. [2:15:57, 2:16:00]: So moved. Ms. Kent, uh so moved. The second. [2:16:03, 2:16:04]: [8164.5, 8167.4]: Mr. Howzan, I second that. Any further discussion? [2:16:07, 2:16:09]: If not, all in favor please indicate. [2:16:10, 2:16:13]: Thank you, Mr. Council, and thank you, Mr. Aaron. [2:16:14, 2:16:15]: Yes, Mr Mayor the next [2:16:16, 2:16:18]: Council consideration to approve the award. [2:16:18, 2:16:24]: Uh for the request for proposal RFP number two zero two two dash zero zero zero six. [2:16:25, 2:16:35]: On call general engineer engineering services for the city of Stockbridge to Falcon Design Consultants, LLC, and Carter and Sloop Consulting Engineers. Mr. Aaron, please. [2:16:35, 2:16:55]: Yes, Mr. Mayor, before we explain, uh Carter and Sloop will be removed for consideration tonight because they only got their agreement this morning. They didn't have time to review it. So they'll be on an upcoming meeting. But we're asking uh mayor and council to approve awarding the on one of the on-call engineering firms to [2:16:55, 2:17:15]: Falcon Design. Falcon Design has done a lot of work for the city. They currently have 15 projects in various stages that they're working on for the city. It has been a very beneficial relationship for the city and some of the projects we've done over the years. And I just ask that mayor and council approve awarded an on-call engineering. [2:17:15, 2:17:20]: engineering bid to Falcon Design Consultants. Mayor. Yes, ma'am. Go ahead, please. [2:17:20, 2:17:33]: I move that we approve um and award our RFP request for proposal on call general engineering services to Falcon Design Consultant. Sir. Okay. Further discussion. Yes, ma'am. [2:17:36, 2:17:48]: And to remove Carter and Sloop off of the um oh off of this motion. Do we need another second to that? Second. Okay. Mr. Alzheimer's second that thank you, Ms. Clerk. And uh Ms uh Barber, go ahead please. [2:17:51, 2:17:51]: Um [2:17:53, 2:17:55]: I wanted to ask Mr [2:17:56, 2:18:00]: Aaron, so I'm not sure exactly when, but the council approved [2:18:01, 2:18:03]: Changes to our procurement процесс. [2:18:04, 2:18:07]: It requires at a minimum of five [2:18:07, 2:18:10]: um members of the evaluation committee. [2:18:10, 2:18:11]: I noticed that. [2:18:12, 2:18:13]: Item ten. [2:18:14, 2:18:17]: There were five members of the evaluation committee. [2:18:18, 2:18:19]: For item ten. [2:18:19, 2:18:21]: On August sixteenth. [2:18:22, 2:18:24]: But item eleven on the agenda. [2:18:24, 2:18:26]: There's only three members. [2:18:26, 2:18:28]: Of the evaluation committee. [2:18:30, 2:18:31]: For the engineer. [2:18:32, 2:18:32]: Yes. [2:18:33, 2:18:40]: Why is that? It was my understanding that they had five members. Procurement, I submit a list of [2:18:40, 2:18:42]: candidates to procurement. [2:18:42, 2:18:49]: For the committee and and they're the ones that put together the committee. They ask me for names and I submit names. I see four. [2:18:49, 2:18:54]: I'm going to abstain from voting on this one for now. [2:18:54, 2:18:56]: Can't pay us without three. [2:18:57, 2:18:58]: No, no, I can't. [2:19:00, 2:19:10]: All right, so anyway, the motion was made in the second, right? So let's take the count here. All in favor of motion, please indicate. Ma Mayor. Yes, ma'am. Okay, go ahead. [2:19:11, 2:19:23]: Uh, Councilman Barber, can you explain to me what you're saying was done what what you are needing information on or what happened?'Cause I'm not quite I heard you say something about five. [2:19:23, 2:19:30]: But you mean five bids or five what exactly five members of the evaluation committee? Mm-hmm. Um [2:19:31, 2:19:32]: So for item ten. [2:19:32, 2:19:34]: There were five members. [2:19:35, 2:19:36]: I can't remember exactly. [2:19:37, 2:19:38]: Ms. Holliday, do you remember [2:19:39, 2:19:42]: Um the time frame in which the council approved. [2:19:42, 2:19:44]: Those revisions to our procurement. [2:19:45, 2:19:46]: Processes. [2:19:46, 2:19:47]: That requires [2:19:48, 2:19:49]: A minimum of five [2:19:50, 2:19:53]: members of the evaluation committee. Do you remember when we did that? [2:19:55, 2:20:03]: I can tell you it was June, but whether or not it was the council member meeting in June or the work session, but it was approved in June of twenty twenty two. [2:20:04, 2:20:06]: Okay. Mr. Gardner. [2:20:12, 2:20:17]: I just want to make sure that we are consistent in what we're doing. Um [2:20:18, 2:20:23]: The item ten, there were five members of the evaluation committee. [2:20:24, 2:20:26]: But this item, item eleven. [2:20:26, 2:20:28]: For the on call service. [2:20:29, 2:20:30]: There is only three. [2:20:31, 2:20:32]: Three members. [2:20:33, 2:20:34]: of the evaluation committee. [2:20:34, 2:20:36]: Can you explain that? Why? [2:20:37, 2:20:47]: Okay. Cannot I know I don't know why it's only three uh I can find out but right now for the sake of us moving this forward, I'm going to approve it. [2:20:47, 2:20:48]: This time. [2:20:48, 2:20:49]: But please. [2:20:50, 2:20:53]: Will you please make sure that staff is consistent? [2:20:53, 2:21:06]: in what they're doing with their processes in procurement. Yes, ma'am. With only having because this council approved revisions to the processes. I just want us to be consistent. Understood. That's all. Thank you. Thank you. [2:21:07, 2:21:22]: All right, so it's there's a motion on the floor to accept this proposal for um Falcon Design and and uh Carter Sloop is not uh going to uh at this time is not going to be on this uh acceptance for this uh going forward, is my understanding. [2:21:24, 2:21:32]: And it's been seconded by Mr. Alexander. Motion by my my Ms. Gantt. So all in favor of motion, please indicate. All right, so it m now passes three zero. Thank you. [2:21:34, 2:21:54]: Council consideration to approve the purchase of a Calipillar in Inc. Model 289 D3 compact track loader skid steer under Georgia statewide contract number 99999-001. That's SPD00000. [2:21:54, 2:22:14]: With uh Yancey Brothers incorporated an amount of$131,787. Funding source is the Water and Sewer Department budget budgeted funds. Mr. Aaron, please. Yes, Mr. Mayor. The Water and Sewer Department uh budgeted for the purchase of a skid steer. [2:22:14, 2:22:34]: That would be used to clear water and sewer easements. It'll have a mulching attachment so that they can cut down trees and limbs and things of that sort. Previously, in the past, when we've had something, a large-scale project, we've had to bid it out. We just completed a project and we spent over$40,000. So if we get to the [2:22:34, 2:22:54]: point we can do it in-house we'll be able to recognize the savings also the skid steer can be used for other activities within the water and sewer department and public works as well so these are budgeted funds and we're just asking that council approve this purchase so that we can do some maintenance work on our own and not rely on contractors to do [2:22:54, 2:22:55]: Do it. [2:22:55, 2:23:00]: Uh thank you, sir. Councillor questions for Mr. Aaron. If not, I need a motion. [2:23:02, 2:23:03]: To accept his proposal. [2:23:03, 2:23:23]: Mayor, I move that we um accept the proposal that um Mr. Aaron just mentioned here. Okay, Ms. Gantt, is there a second? Second. Okay, Ms. Barber second. Ms. Barber second. Any further discussion? All in favor, please indicate. All right, fantastic. Pass three zero. Thank you, sir. Thank you, council. Okay. Council consideration. [2:23:23, 2:23:43]: To amend FY 2023 El Meg list to remove North Bridge Drive and replace it with Burke Street and the portion of Davis Road that was impacted by the Burke Street sewer project. Mr. Aaron, please. Yes, Mr. Mayor. In the next coming years, the city will be having a sewer project on North Bridge Drive that will [2:23:43, 2:24:03]: Will require us to make some road cuts. So we don't want to resurface the road and then two years later we go back and make some cuts to it. And while we when we did the sewer project on Burke Street and Davis Street, we had to excavate the center of the road, so we just patched it. And so we want to switch uh North Bridge with Davis Road and [2:24:03, 2:24:23]: Uh Burt Street so that we downtown maintain that clean, pristine image. You know, you don't want people coming through the downtown area wondering why that big patch is down the center of the road. And also by switching these roads, Birch Street was scheduled to be resurfaced in the next couple of years. We're gonna realize a savings of three thousand dollars by removing North. [2:24:23, 2:24:26]: Bridge Drive and adding Burke Street and Davis Road. [2:24:27, 2:24:29]: Good deal. Thank you, sir. Appreciate it. Councillor questions. [2:24:31, 2:24:32]: Okay, I need a motion. [2:24:33, 2:24:45]: So moving. I second. All right. Miss Alexander to Miss Gantt. All in favor, please indicate. Fantastic. Thank you, sir. Thank you, Council. Thank you, sir. Thank you, Miss Mayor and Council. For this project. Your motor. [2:24:46, 2:24:55]: Council consideration to authorize a city manager or his designee to apply for and receive US Department of Transportation Reconnecting Communities Pilot Grant Program. [2:24:56, 2:25:00]: The grant is to support the planning activities and preliminary engineering of constructing [2:25:00, 2:25:02]: І подъестрін бридж алонсайд. [2:25:02, 2:25:06]: The Martin Luther King Senior Bridge for a total project cost of two hundred [2:25:07, 2:25:10]: Five thousand two hundred and thir uh thirty nine dollars and ten cents. [2:25:10, 2:25:22]: Funding source uh federal share one hundred and sixty four thousand one ninety one and twenty eight cents and the city cost share forty one thousand forty seven dollars and eighty two cents. The cost share [2:25:22, 2:25:33]: will be allocated from T S PLOS. It says presented by oh Kelly Kelly Kelly Russell. Fantastic. Good to see you, ma'am. Good to see you too there. Good evening, Council. [2:25:33, 2:25:45]: Um, I'm Kelly Russell, the city admit I mean I'm sorry, the grants administrator for the city. And what you have before you is the um approval, the request for approval for the city manager to submit an application. [2:25:45, 2:25:48]: for the um infrastructure grant. [2:25:48, 2:25:51]: Фонд байда ЮС департ о транспорте. [2:25:51, 2:26:02]: This grant will allow the city to position itself, do the legwork to position itself to apply for then construction costs for us to build the pedestrian bridge alongside the Martin Luther King. [2:26:02, 2:26:04]: Senior um [2:26:04, 2:26:05]: Memorial Bridge. [2:26:06, 2:26:09]: And so we're requesting your approval to have for us to submit the application. [2:26:10, 2:26:22]: Okay, fantastic. Now you said besides, but it's really gonna is it really gonna be connected? It'll be connected to the bridge, right? It's not when you say bes by the side, you're not gonna have any type of gap between a bridge and this pedestrian piece. [2:26:22, 2:26:36]: Um so you all had a and um approved a R S V P plan in twenty and eighteen. Right. And option three sort of illustrated what that project would look like, and I believe it is uh Jason or [2:26:37, 2:26:39]: It may be its own structure. [2:26:40, 2:26:47]: Um, and I would like to defer to Mr. Aaron to provide some additional details on the project on the level. All right, fantastic. [2:26:52, 2:26:52]: Oh fuck. [2:26:55, 2:27:06]: Yes, the uh pedestrian bridge it will be a separate structure because G Dot would not allow us to connect directly to the bridge, so it'll be its own structure that spans the railroad tracks. [2:27:06, 2:27:26]: All right. And you have any idea uh the curiosity question, any idea what this uh uh the difference, uh the space difference, how many feet or yards difference from the between the two? Well, we hadn't gotten that far yet with the actual design. We're just trying to uh seek approval so that we can move forward with it. But I know that there was eight hundred thousand dollars. [2:27:26, 2:27:36]: dollars allocated in T splas for that pedestrian bridge. And if you remember if you go to Peachtree City is you're going over [2:27:36, 2:27:43]: It's kinda probably be similar to that pedestrian bridge that goes along Highway fifty five. Uh-huh. It goes over [2:27:43, 2:28:03]: I think it's a railroad track, I'm not too sure. But that bridge it'll look similar. Well we hoping it'll look similar to that in design. Okay. Characteristic, but how far we won't know until we go to get the study approved and it'll tell us what's the best. Yeah, it's just a curiosity question. I was just wondering. Anyway, council, again, questions? Yes. Well, this uh total application include lighting. [2:28:03, 2:28:21]: And there are all the accessories to go with the bridge, intense as uh lighting should be incorporated in in the request, I would think. Well the the application is to develop the study and the report that will identify the needs for lighting, utilities and things of that nature to construct the bridge. [2:28:23, 2:28:24]: Okay. [2:28:26, 2:28:46]: This this just gives this allow for us to get the federal funding to actually do the study. Okay. Once they once they complete the study, that part of that would be obviously what the design characteristics would look like. Cause I know there's one that has the words stockbridge written over it and lights. Mm-hmm. So you know, we don't know if they'll [2:28:46, 2:28:57]: We'll approve that but definitely we'll know once we finish the study what the concepts will look like and then which one we will actually send to the FedS for for funding for construction. [2:28:57, 2:29:10]: All right. Okay. Any other any other questions? Council. Need a motion to accept this, please. So moved. Okay, Ms. Gantt and Miss Barber. Ms. Gantt and Miss Barber, any further questions? If not, all in favor, please indicate. Thank you very much. Thank you, Kelly. Appreciate it. [2:29:12, 2:29:19]: Council consideration to approve the job description for police lieutenant and administrative manager position. Presented by Chief Trammer, please. [2:29:20, 2:29:23]: Good evening, Chief. Good evening, Mayor and Council. Good evening. [2:29:24, 2:29:44]: Uh this is actually uh we've had some an opportunity obviously um operating over the last several months to evaluate our operations to look at uh operational efficiencies and how we can be more effective. Uh currently we have twelve supervisory positions throughout the department. Those are all hourly positions because we [2:29:44, 2:29:50]: work twelve hour shifts. Uh we don't work a standard two thousand and eighty hour um a year. [2:29:50, 2:30:10]: Uh cycle. The officers or the supervisors in this case actually work 2,184 hours. So there's 104 hours of administratively uncontrollable overtime that's built into those positions. And in looking at the way that we're aligned, uh we are anticipating absorbing code enforcement after the first of the year, so we need to build in a mechanism for. [2:30:10, 2:30:30]: For oversight there. And then, furthermore, to allow for the growth and development of our personnel and to provide for succession planning, we'd like to create a police lieutenant's position. We're not asking to add any additional positions to the organizational structure. We're still remaining at 58 full-time employees, but we would be reclassifying those positions. Those positions would be [2:30:30, 2:30:49]: be converted from hourly positions to exempt positions. And by virtue of doing that, we actually would realize a cost savings of about$10,000, nearly$2,000 per position by converting those positions again to exempt positions. That's what we're asking the council to approve this evening. Thanks, Chief. Any questions for [2:30:50, 2:30:53]: Chief Tremor, no Yes, this agenda item [2:30:53, 2:30:55]: The background says that [2:30:56, 2:30:58]: Stockbridge Police Department is requesting to add [2:30:59, 2:31:01]: A police lieutenant position. [2:31:03, 2:31:06]: That's the position, not not the actual [2:31:07, 2:31:09]: not additional positions is to add the [2:31:10, 2:31:11]: Perhaps it wasn't worded um [2:31:13, 2:31:18]: Right. So it's to prove the job description for i is what I have on here. Maybe there's a [2:31:22, 2:31:34]: Okay. So you're saying we're saving ten thousand by making the making these positions exist. Ex as salary instead of hourly. Correct. Okay. And currently [2:31:36, 2:31:40]: But the hourly positions still have health care and all the other benefits, correct? [2:31:40, 2:31:45]: Correct. Okay. And nothing would change as it relates to the benefits associated with those positions. Okay. [2:31:45, 2:31:45]: All right. [2:31:47, 2:31:49]: Yeah, questions, if not, I need a motion. [2:31:50, 2:32:02]: So move. Mr. Alexander. I second. Okay, Miss Gantt. All in favor, please indicate. Fantastic. Thank you, Chief. Thank you. All right. We're passed three zero. All right, so uh items. [2:32:03, 2:32:12]: Sixteen, seventeen, eighteen of be uh be next month. So we'll now move on to matter of fact, uh next item is Mr. Alexander. [2:32:13, 2:32:15]: You would ask to add something item to the agenda. [2:32:16, 2:32:32]: Yes, I just wanted to make sure that I was following proper protocol and getting approval for the usage of the amphitheater for the town hall be concerning public safety. Uh the sheriff has agreed to come and several other individuals. I'd like to make a motion for approval for that. [2:32:32, 2:32:52]: I second. Okay. All favor, please indicate. Now let me tag on to this as well. You know, maybe I did maybe I missed something here. I had I also I'm in I'm actually in partnership with uh Miss Shaw in reference to her funding pitch, which was on the twenty sixth. I probably should have came to the council and asked for permission for that as well. [2:32:52, 2:32:59]: Shame off shame on me for that. So that made me think about that when you brought this up, Mr. Alexander, and then Miss Shaw was here tonight. [2:32:59, 2:33:05]: Uh so I know I didn't add this on, I guess in a sense of thinking, but I'm I I probably should have asked that. So [2:33:05, 2:33:25]: I don't know how we go about adding it. This amended w let's uh make a request to amend the agenda to add the item uh described by the mayor for the funding pitch and use of the amphitheater. Yeah, right. No, it's but not the amphitheatre. It's mural manners. I didn't think we I thought we had a rule on that already. Well, that's why automatically approve those. [2:33:25, 2:33:27]: I thought we were still requesting. Yeah. [2:33:28, 2:33:31]: Are we still requesting those, uh Miss Holliday? [2:33:32, 2:33:34]: Do we still request for the murmuranders? [2:33:35, 2:33:36]: Do we still vote for that? [2:33:38, 2:33:39]: Right. [2:33:40, 2:33:54]: Okay, the Merlman is a different man, it's not the amphitheater. Okay, okay, okay. So I'm I'm all right then. All right. I'll just you made me think about am I doing something not quite right here? Mayor, we can check it and and just simply ratify it if that's the case. [2:33:54, 2:34:05]: Okay. All right. So we'll move on. Okay. Uh okay. So what we have next is lost. Um uh the resolution for lost. Uh Ms Mr. Washington. [2:34:06, 2:34:07]: Mr Washington. [2:34:09, 2:34:15]: Uh John, please retrieve our attorney please. [2:34:29, 2:34:32]: As we take a mild little break here. [2:34:45, 2:34:54]: Yeah, we'll just have air conditioning off. Mm-hmm. I know. Council Alexander, in your [2:34:55, 2:34:59]: made the request, I believe you said October twenty eighth, but you made the twenty seventh, correct? [2:35:01, 2:35:05]: It's a Thursday. The twenty seventh, that's right. [2:35:06, 2:35:26]: That's correct. 27th of the Mr. Washington, loss, the resolution for loss, sir, please. Yes. So Mayor and Council, we've been having spirited discussions with our Henry County and our the city counterparts about the loss negotiations. And we're currently at a standstill, and we may be going to um an arbitration of which the county [2:35:26, 2:35:46]: Has not agreed to attend yet. What we're asking for in all of the counties, this all of this went through McDonough and it's coming around to the other cities as well. We're asking to sign off on this resolution saying that we at least want and our citizens would support the split that we had from 10 years ago, which we [2:35:46, 2:36:06]: Was the 6634. We're asking that Mayor Ford go to the October 18th meeting. And if you all want to come as well, you are welcome to speak out on behalf of the disastrous consequences if we do not reach a decision on lost, and also if we do not get a split that would still benefit. [2:36:06, 2:36:26]: Us. Lost gives us, as you note from Mr. Gardner's presentation, roughly five to six million dollars a year. That is predicated upon the split that we have from 10 years ago, which the county is in opposition to. And so I mean Ford can tell you, and we can as well, that we've not been able to reach any. [2:36:26, 2:36:46]: Anything close to that. And we're still working really hard to try to get them to come to the table, but part of it is going to require some level of public support and public pressure that we place on them. And so this resolution will be a part of that piece in that strategy. Thank you, Mr. Washington. I appreciate it. And we need appreciate you all the efforts you're doing here. [2:36:46, 2:37:06]: Anyway, council. Questions and concerns if questions for Mr. Washington at this point, if not, just need a motion to accept this. And I I think uh certain of our I think it would be helpful if the city manager would come to propony and uh let I mean this is a public meeting. Yes it is sir, no problem. [2:37:06, 2:37:10]: Yeah, I got you. Mr. Gardner? Mr. Gardner. [2:37:15, 2:37:35]: Can you further further explain how critical this is issue is in reference to the loss and the the negotiations and the fact that uh we have not come to a viable resolution between the cities are all in agreement, but not a viable resolution with the county, how serious this is and what we're gonna do in the sense of hopefully approving this resolution here. If you can explain any further in reference to clarification. [2:37:35, 2:37:48]: for the public's awareness of what's going on. Yes. So uh as I mentioned, every every ten years um under law we're required to negotiate with Henry County [2:37:48, 2:37:50]: All the municipalities, Stockbridge, [2:37:51, 2:37:53]: McDonough, Locus Grove and Hampton. [2:37:54, 2:37:55]: Of two [2:37:56, 2:38:16]: negotiate this share of the local option sales tax or sales tax as we know it, right? Um over the last 10 years. Um it was agreed upon back into 2013, 2012, going into 2013, and that split was 66 [2:38:16, 2:38:20]: With the county getting sixty six percent. [2:38:20, 2:38:23]: Thirty four percent come to the cities, the cities then split. [2:38:24, 2:38:25]: That thirty four percent. [2:38:26, 2:38:27]: Between us. [2:38:27, 2:38:29]: Um it wasn't a [2:38:29, 2:38:31]: population base split back then. [2:38:32, 2:38:34]: Биказ атаку [2:38:34, 2:38:37]: The city of Hampton had not grown but [2:38:37, 2:38:51]: a lot and so the city of Stockbridge and the city of McDonough gave a percentage of their sales tax to the city of Hampton to make them hold back in twenty thirteen for twenty thirteen. [2:38:51, 2:38:52]: Um [2:38:53, 2:38:56]: This year the county came in with a recommendation [2:38:56, 2:38:58]: They they get eighty percent. [2:38:58, 2:39:02]: And the cities get a split of only twenty percent. [2:39:03, 2:39:05]: That was their first initial stance. [2:39:05, 2:39:06]: We the city. [2:39:07, 2:39:09]: Путфорд а терд апроч. [2:39:09, 2:39:11]: Чула County saying, Hey. [2:39:12, 2:39:15]: We understand that all of our communities are growing, respectively. [2:39:15, 2:39:20]: But we think and based on the eight criteria's that are listed under the law. [2:39:21, 2:39:23]: But the law is not direct. [2:39:24, 2:39:30]: It has vagueness in it and according to our former state representative, mister Andy Welsh. [2:39:30, 2:39:32]: The legislature has not saw a fit. [2:39:33, 2:39:37]: to make any amendments to do away with this ambiguity. [2:39:37, 2:39:38]: or vagueness in the law. [2:39:39, 2:39:42]: So hence we are stuck with [2:39:42, 2:39:56]: These are the criteria you should review versus those eight criteria that you shall use. And that's where the the rubber hits the road, the difference between should and shall. [2:39:57, 2:39:58]: Um [2:39:58, 2:39:59]: And so the county [2:40:00, 2:40:05]: came back to us. We met, I think, three times with the county, the last time being [2:40:05, 2:40:10]: Last week Wednesday, um the city manag the county manager called a meeting of the managers and the attorneys. [2:40:11, 2:40:13]: Um and [2:40:13, 2:40:16]: Pretty much came up with a teared approach. [2:40:16, 2:40:19]: That as I outlined to you guys in my memo. [2:40:19, 2:40:20]: To you. [2:40:20, 2:40:28]: Whereby at the end of this tenure period or the last four years of this tenure period, they will get somewhere around seventy-three percent. [2:40:28, 2:40:31]: of the lost and the cities would get [2:40:31, 2:40:35]: Twenty seven or twenty six or twenty eight, somewhere around there. [2:40:35, 2:40:37]: What that does to us. [2:40:37, 2:40:38]: Is that percentage? [2:40:39, 2:40:47]: Affects the amount it comes to the city. And as the city is currently configured, sales tax is our biggest form of income. [2:40:48, 2:40:54]: that we provide all of our general services by to include police services, right? [2:40:54, 2:40:58]: So right now we're at about five point one [2:40:59, 2:41:04]: A few years ago was five point nine and that was just based on sales activities going on. [2:41:05, 2:41:07]: We're in an environment right now where we're [2:41:07, 2:41:13]: hot on the tails of not just being inflation, but now recessionary times. [2:41:13, 2:41:14]: Right. [2:41:15, 2:41:18]: Вічкан афект сел так, аз но. [2:41:18, 2:41:27]: Right. Um hence you saw the difference in the us taking a a a real mild mild-minded approach to our sales tax revenue. [2:41:27, 2:41:30]: But if those numbers fall under [2:41:30, 2:41:50]: The five million that we've been collecting over the last six or seven years under the agreement, that affects what services we can provide and will have potentially have to cut as a local government. And those services are enumerated under our general fund, which are public safety, police, public works. [2:41:50, 2:42:05]: Right. Um administration, city clerk, government body, those entities that are funded with those with those tax with those tax dollars, those sales tax dollars. So that's the that's the ill effect of what can happen. Um [2:42:05, 2:42:24]: I think obviously from what I mentioned in my memo to you guys, you know the way we perceive is that we would like for the county to go into arbitration with us. Um in twenty twelve there was a arbitration clause to allow for us to go to what was known back then as baseball arbitration. [2:42:25, 2:42:28]: Ам да вас дім унконститучно бада Джорджа Супрім Корт. [2:42:29, 2:42:41]: Hands kicked out, so now we're stuck with the situation where we are, where we just get a mediator, but we can call for arbitration, which we our goal is to do so if the county doesn't wish to attend. [2:42:41, 2:42:42]: We'll attend in earnest. [2:42:43, 2:42:52]: And we'll have that frank discussion amongst the cities and everybody will know that the county is putting itself in a tenable untenable situation. Now, under the law [2:42:54, 2:42:57]: We have until December thirty first in which to come to an agreement. [2:42:58, 2:43:00]: If there is no agreement [2:43:01, 2:43:02]: At midnight. [2:43:02, 2:43:04]: December thirty first. [2:43:05, 2:43:07]: Loss goes away for everybody. [2:43:08, 2:43:10]: And the only way it comes back. [2:43:10, 2:43:12]: Is for there to be put on [2:43:12, 2:43:14]: A referendum on the ballot. [2:43:15, 2:43:17]: At the next election cycle. [2:43:17, 2:43:20]: Um, for to come back. [2:43:20, 2:43:25]: And if the voters don't approve it, we have lost loss. As you know, once you [2:43:25, 2:43:29]: Give someone something and you take it back is how to get it back. [2:43:29, 2:43:38]: Um so that would be the ill effects if we can't get to an agreement with the county by December thirty-first that loss goes away for everyone. [2:43:39, 2:43:45]: Well that's Yeah go ahead, sir. [2:43:45, 2:43:49]: Yes. But but here's here's the catch. There's a kicker in this. They told me they don't care. [2:43:50, 2:43:51]: [9832.8, 9838.3]: The counties the county in and of itself can can call for a host. [2:43:58, 2:44:01]: Which the Cab County currently operates under. [2:44:02, 2:44:02]: Right. [2:44:03, 2:44:09]: Um they can do that. And if that's approved, they're the only ones to get that. The cities don't get a share in host. [2:44:10, 2:44:15]: Right, and that's a big issue with what's happening in the Cap county and one or two other counties that actually did this. [2:44:15, 2:44:17]: Um, some years ago. [2:44:17, 2:44:37]: But if they did that, then that it had to go back on a referendum and they would lose the money uh initially and they would have to raise taxes tremendously to cover their shortfall. So the property tax owners would be looking at a tremendous spike to cover this, which basically is being covered now by a one-cent sales tax. [2:44:37, 2:44:42]: Tax and the property tax owners should understand they're the ones that are gonna be soaked, right? [2:44:43, 2:44:51]: Yeah. At some point the county will like all of us will have to dig into reserves and at some point someone is gonna shout, Uncle [2:44:51, 2:44:53]: Because somebody's gonna run out of money first. [2:44:53, 2:44:56]: Um and at that point, um [2:44:56, 2:44:58]: That's who will be the loser. [2:44:59, 2:45:04]: And you know, the ones with the highest swim violence are the ones that'll take the longest before they scream. [2:45:05, 2:45:05]: Right. [2:45:06, 2:45:12]: Oh Ms. Gann, go ahead, please. Um let me say this. Um [2:45:13, 2:45:22]: I was personally told that the county will not go to arbitration. I was personally told that they don't care if we all lose money. [2:45:23, 2:45:31]: I'm very offended by that and I think that's poor leadership. And I am not gonna be bullied or held my feet to the fire. [2:45:32, 2:45:37]: For because this is for all of Henry County. We should always be about Henry County. [2:45:38, 2:45:48]: In general, in general, the entire county. How selfish are we? We already lost money with splost. How selfish? The population has increased. [2:45:50, 2:46:02]: Population has increased in the city. In all cities. And what I what I my biggest concern about this is, it is from my understanding that the numbers that the county and I want people to know this. [2:46:03, 2:46:04]: Because [2:46:05, 2:46:08]: For some reason, the coun county commissioners [2:46:08, 2:46:15]: And and please, uh you know, some of them are my friends, but for some reason, when they get in those positions, [2:46:16, 2:46:18]: Mayor and council [2:46:19, 2:46:33]: They forget that we still have to vote for them. They still represent the cities. They still have a part of that city. However, when they fund things, when they want to do their roles, oh it's not their role. This this is unincorporated. [2:46:33, 2:46:38]: But now you wanna include us in your percentage. [2:46:38, 2:46:43]: So their eighty percent included the city limits of Stockbridge. Then they give us the other [2:46:43, 2:46:45]: Half of that percentage. [2:46:45, 2:46:47]: And then tell us [2:46:47, 2:46:57]: Hey, we want you to join with us and put your money back in. Well, you've got money back in. You got your taxes, you've done all kind of stuff, your millage rates, and then you turn around. [2:46:57, 2:46:59]: And try to rape us. [2:47:00, 2:47:02]: In the rest of the cities, and it's not gonna work. [2:47:03, 2:47:04]: It's wrong. [2:47:05, 2:47:07]: You're double dipping. You're triple dipping. [2:47:07, 2:47:10]: You wanna include us in your population. [2:47:12, 2:47:15]: And then you wanna give us a little percentage. [2:47:15, 2:47:20]: And then you want to turn around and say, hey, we want you to join with us and pay for this project. [2:47:21, 2:47:22]: That's not gonna happen. [2:47:23, 2:47:26]: And I hope that we all stand firm with that. [2:47:27, 2:47:28]: And anybody. [2:47:29, 2:47:35]: Who goes around and say, oh well, we don't care, we'll just not go to arbitration, should not be in office. [2:47:37, 2:47:51]: It's gonna take some city council members to run for these positions in the county and be fair for the both the unincorporated and incorporated. I don't care who you are. I'm fed up. This is nine years and counting. [2:47:52, 2:48:10]: This is supposed to be about making Henry County great. The vision of the technology area, the medical area, the area where they have logistics, the area where they have um the retail and the shopping and the food. We're supposed to be working together, but instead. [2:48:11, 2:48:13]: We're fighting for what we deserve. [2:48:14, 2:48:15]: And it is dead wrong. [2:48:16, 2:48:16]: Correct. [2:48:17, 2:48:17]: And so [2:48:19, 2:48:20]: They don't want to go to arbitration. [2:48:21, 2:48:26]: Then let's get some city council members to run for their positions because they're gonna lose. [2:48:26, 2:48:28]: out on the entire county. [2:48:29, 2:48:35]: It's gonna take people who care about both the city limits and unincorporated, people who are fair. [2:48:36, 2:48:47]: Because right now that's not what's going on and I'm tired of it. This is the most selfish asinine thing I've ever heard of in my life. And I quote, I hope the AJ C and the Himmer Herald is listening. [2:48:49, 2:48:50]: That's all. [2:48:50, 2:48:53]: Thank you, ma'am. Okay, appreciate that. Uh Miss Barber, please. [2:48:54, 2:49:00]: Um I'm very disappointed. Disappointed that they don't even want to [2:49:01, 2:49:03]: meet or go through arbitration. [2:49:04, 2:49:05]: At all. [2:49:06, 2:49:07]: I know this is politics and all. [2:49:08, 2:49:09]: But they are people. [2:49:10, 2:49:12]: People involved. [2:49:13, 2:49:15]: All of us will be affected by it. [2:49:16, 2:49:17]: Every city [2:49:18, 2:49:23]: Are we are we the only city that's um passing a resolution? [2:49:23, 2:49:43]: No, they all are. The first one that did it, they did it last night in McDonough. Then we're up next and Hampton's also at a retreat. They're going to do it so all four of the cities are doing it. Yes, ma'am. This is a coordinated effort by all four of the cities. And our goal is to stick together as municipalities here in the city to get what we [2:49:43, 2:49:53]: deserve, not just what we think we deserve, but what is outlined under the law, under those eight characteristics that they should be looking at to distribute the sales tax. [2:49:54, 2:50:05]: Wow. And so that's why we're going to have when if when you all approve this what happened to the report and if you all wanna come as well, that will be presented to them at their October eighteenth meeting. [2:50:06, 2:50:09]: Thank you. Mr. Alison, do you hear any comments, sir? [2:50:09, 2:50:20]: Uh uh no, I mean mine initially I'm I concur with my colleagues and this is just a a terrible situation. It needs to be rectified and uh everybody needs to be gave it comfort. [2:50:20, 2:50:40]: So do we need a motion for this? Well well actually for the resolution we do, but I'm gonna say this as well. I've I've I responded to you all in a email uh pretty a couple of days or so ago and so you have my thoughts on that, but just to publicly announce the fact that I'm glad the city's just sticking together on this aspect that we we we've we fight together uh in in this aspect here. [2:50:40, 2:51:00]: And uh it is unheard of and so we we have to go to arbitration. We need to pull uh push the button and keep moving on this'cause I'm not happy about this either. It's it's does it's not proper, not right in this aspect. But uh I look forward to uh further dialogue and for us to at the four cities to the continue to move in one direction to to do to what [2:51:00, 2:51:15]: What's right for our citizens, period. On that note, I I need a motion to accept this, please. So move. Is there a second? Ms. Barber second then. All favor, please indicate. Fantastic. Thank you very much. Thank you. Gentlemen, great.
