I'm requesting that the Planning Commission deny the request to rezone the high density residential. [0:09:50, 0:09:56]: The existing plan as it is presented has many concerns in addition to what I'd like to [0:09:57, 0:10:01]: verbalized as concerns on the development of that property overall. [0:10:03, 0:10:06]: She goes into specifics, etcetera, but she does not identify. [0:10:07, 0:10:10]: Which zoning application she's referring to? [0:10:10, 0:10:15]: But for the benefit of the public and her, I want to acknowledge that she did tender a letter to the council. [0:10:15, 0:10:16]: Opposing [0:10:17, 0:10:19]: Whatever, I don't I'm not sure. [0:10:20, 0:10:21]: That being said. [0:10:24, 0:10:27]: Final plot approval for town homes, item number seven. You have to read it. [0:10:57, 0:10:59]: Yeah, yeah. What else is that? [0:11:06, 0:11:07]: Pardon me? [0:11:32, 0:11:35]: You see that? I'm not seeing uh [0:11:45, 0:12:02]: Can I clarify the letter? Ma'am, you can't stand up right now. This was You have to you out of order, ma'am. You have to have it. This is what the information is. Okay, ma'am. [0:12:29, 0:12:31]: Item number seven on the agenda is compar uh [0:12:33, 0:12:36]: It says to be presented by the community development staff. [0:12:38, 0:12:42]: It says below but to be presented by the community development staff. [0:12:43, 0:12:44]: Yeah, but not really into the record. [0:12:47, 0:12:53]: All right, final plot approval for town homes at the bridges at Jodico Development, Council District Five. [0:13:06, 0:13:07]: Do you see that? [0:13:08, 0:13:09]: Yes. [0:13:41, 0:13:43]: The staff is gonna have to uh [0:13:48, 0:13:51]: Yeah, yeah, they got a little more than that. [0:13:52, 0:13:53]: Let me talk to her. [0:13:56, 0:13:59]: Mr. Logan, may I speak to you for a minute? May I speak with you? [0:14:16, 0:14:18]: Yeah. [0:14:19, 0:14:19]: It's all [0:14:20, 0:14:26]: We don't have a presentation. This is just for your for your information. This is for you to come. [0:14:26, 0:14:30]: Chairman Abula, just move to the next item please, and we'll come back to th that one next. [0:14:32, 0:14:33]: Okay. [0:14:39, 0:14:40]: I don't mean [0:14:40, 0:15:00]: Zoning modification case number ZM two oh two three-one. Council District 5 considered a request for a change in zoning for a modification to amend Bridget of Jodico conceptual plan to allow multifamily residential development in part A and to allow senior family residential in part B identified by parcel number 055. [0:15:00, 0:15:20]: The property had 14.63 plus or minus acres and is accessed via 10 Parkway and Guento Drive and landlots 7778 and 83 of District 6. Applicant by Michelle Y. Sadi. [0:15:20, 0:15:24]: Member Applicant of Southern Consulting Services Inc., owner. [0:15:33, 0:15:45]: Thank you, uh Chair Chairman Abdullah. Um my name is Gordon Linton, Planner One for the City of Stockbridge, and I'm here to to present the case for ZM twenty twenty-three-zero one. [0:15:51, 0:16:11]: The case facts the applicant is Michelle Y Sali of Southern Consultant Services Inc. The owner is uh Jodico one five eight LLC and is the request a change in the zoning modification to amend the bridges of Jodico conceptual plan to allow senior family residential in POD B and to allow [0:16:11, 0:16:21]: Multifamily residential development in Pod A. Please note that this is not a rezona case, but rather a change to the uh Bridges of Judico concept plan. [0:16:22, 0:16:42]: The address of the property is twenty-two forty-five Jodeco Road. The number of acres is fourteen point six three zero acres. And the city land use designation is PTD, Plant Town Development District, and it is governed by the design guidelines of the Jodeco Concept, South Concept Plan. [0:16:46, 0:16:52]: This is the aerial photo of the property and highlighted by the star that's where the that's where it's gonna be. [0:16:58, 0:17:02]: That is the zoning map of the area, which is zone PUD. [0:17:04, 0:17:05]: And that's location. [0:17:10, 0:17:14]: That's the Parkway mixes overlay district map as well. [0:17:21, 0:17:41]: The bridges of Jolico Side Plan. The bridges the bridges of Jolico Side Plan consisted of approximately 724,000 square feet of commercial space, which included the following three retail superstores, specialty retail, restaurants, gas stations, a bank, grocery store, and a daycare facility. [0:17:41, 0:18:00]: The original site plan of the mixed-use development included two hotel rooms, which 110 rooms and 120 rooms, 615 multifamily residential units, 300 standalone structures and 300 above commercial, and 14.5 acres of open space. [0:18:03, 0:18:10]: That's the another side plan up the uh bridges of Jolico again. And that's where the location was. [0:18:16, 0:18:20]: The new conceptual side plan of Bridges of Jellico, the revised [0:18:21, 0:18:41]: The revised site plan the applicant has provided shows the 12-story hotel and the out parcels, which are approximately 125,000 square feet. The out parcels included a 35,000 square foot office space and other recreational uses. The site plan shows the approved 306 multifamily units and the approved 130,000. [0:18:41, 0:19:01]: 35 townhomes. The applicant proposes to build a multifamily residential development with 219 multifamily units. The addition of the proposed 219 multifamily units will bring the total to 660 units. The proposed changes to the bridges of Jolico are still below the approved DRI for both. [0:19:01, 0:19:02]: Both the total square footage. [0:19:03, 0:19:10]: and number of units for the development. Thus the proposed zoning modification will not have a negative impact. [0:19:18, 0:19:32]: The project information, the applicant proposes to build an apartment with two hundred and nineteen units. In addition, the side plan shows the development will include forty parking garages, amenity area, a clubhouse, and a dog park. [0:19:34, 0:19:35]: And that's the side plan right there. [0:19:40, 0:20:00]: Staff analysis. The reasonable of the applicant's requests. The applicant's request to amend the Bridges of Jodico's conceptual plan is reasonable and practical. The original site plan included approximately 724,000 square feet of commercial space, which included the following: three retail superstores, specially retailed. [0:20:00, 0:20:20]: Retail, restaurants, gas station, a bank, grocery store, and a daycare facility. The original site plan of the mixed-use development included two hotel rooms, 110 rooms and 120 rooms, 615 multifamily residential units, 300 standard structures, and 300 above commercial, and 145 [0:20:20, 0:20:40]: Acres of open space. However, the updated site plan the applicant provided shows the approved 12-story hotel and the eye parcels, which are approximately 125,000 square feet. The odd parcels include a 35,000 square foot office space and other recreational use. The site plan shows the approved 360, [0:20:40, 0:20:53]: multifamily unit and the approved 135 townhomes. The proposed changes will not affect the overall square footage and number of units for the development. Therefore, it is reasonable to grant the request. [0:20:59, 0:21:19]: Suitability for the proposed development. The granting of the applicant's request to change the location of the multifamily residential unit in Part A and to allow senior family residential Part B to, as is shown by the submitted conceptual plan, is suitable and feasible. It is better to have an increase in density to support the overall project. [0:21:19, 0:21:21]: and enhanced economic development activities. [0:21:23, 0:21:43]: Number three, if facts on the surrounding properties and infrastructure. The granting of the applicant's request to change the location of the multifamily residential in POP A and to allow senior family residential in pod B will not have a negative impact on the community. The project is compatible with the overall community and surrounded areas. [0:21:43, 0:21:50]: Proposed changes will serve as a catalyst to attract additional high end retail and commercial establishments to the area. [0:21:52, 0:22:02]: Staff recommendation. This staff report has demonstrated that the applicant's proposed location will be acceptable. The staff recommends approval of the zoning modification request. [0:22:06, 0:22:07]: That's the end of the presentation. [0:22:25, 0:22:28]: Any questions by uh planning commission members? [0:22:33, 0:22:36]: Guess the question I would have, does this require a public hearing? [0:22:38, 0:22:41]: Uh, I don't think so. It's just an amendment. [0:22:41, 0:22:43]: Public comments. [0:22:59, 0:23:02]: This is just an amendment uh moving some [0:23:03, 0:23:05]: Trump is around. Yes. From A to B. Yeah. [0:23:13, 0:23:14]: Any questions? [0:23:19, 0:23:20]: Pardon me? [0:23:31, 0:23:32]: Oh no problem. [0:23:40, 0:23:55]: I was directing the the question to Mr. Linton and basically this is a movement, a reconfiguration of the property. So it's not that we're changing the zoning or increasing the density. We're just simply reconfiguring the project. Yes, sir. [0:24:02, 0:24:04]: Any questions? May I have a motion? [0:24:05, 0:24:06]: Public comments. [0:24:08, 0:24:10]: While the staff is drawn, do you [0:24:11, 0:24:12]: Open for public comment. [0:24:14, 0:24:17]: All those and anyone here who supports the project. [0:24:20, 0:24:22]: Anyone here who opposes the project? [0:24:24, 0:24:30]: Have you filled out a seat? If you fill out a seat you could you may approach the podium, tender it to the clerk. [0:24:30, 0:24:30]: Mm-hmm. [0:24:32, 0:24:33]: Sony modification. [0:24:35, 0:24:40]: What issue are we talking about again? Again it's been very hard to hear. [0:24:47, 0:24:49]: Well that you can't hear? [0:24:50, 0:24:51]: You can't hear? [0:24:54, 0:24:54]: Okay. [0:24:56, 0:25:10]: I asked Mr. Linton, the project, the the the proposed amendment here is simply a reconfiguration of the project. It's not requiring the zoning amendment. Councilman Abdul excuse excuse me. Sure. The applicant has to come up and speak first. Okay. [0:25:11, 0:25:21]: Um simply asking uh to for clarification for Mr. Linton that this is really a reconfiguration of the project and not a change, a significant change of anything. [0:25:23, 0:25:26]: We have the applicant present. Yes, sir. [0:25:33, 0:25:53]: Thank you, Mr. Chairman. I'm Jeff Grant. We actually own the property there at Jodico 158. And you are correct. This is not here for a rezoning modification of any type. All we have done when this was was originally approved with the DRI and with Goethe and with the uh city council. Um there was a site plan that was generated. [0:25:53, 0:26:13]: And that things have changed somewhat, but we have not exceeded um any of those errors that were originally approved. It is just basically what we're redoing is reconfiguring where we're placing the residential uh as opposed to the original site plan. It's changed somewhat. And it's it's something that we thought uh [0:26:13, 0:26:30]: Um it probably wasn't necessary, but we would like to go ahead and bring it forward to the council. Um I I don't think it makes um I I think it makes better sense the way we're reconfiguring this thing. I think it flows better. And um and that's really the reason we asked for that modification. [0:26:31, 0:26:32]: Okay. [0:26:33, 0:26:36]: Any questions from the Planning Commission? [0:26:37, 0:26:41]: You know, we'll open it to um public comment. Yes, sir. [0:26:45, 0:26:52]: Anyone who opposes the project, if you filled out a sheet and tendered it to the clerk, kindly approach the podium. [0:26:54, 0:26:56]: Provide us with your name and address. [0:26:56, 0:27:01]: My name is Ann Fields and the clerk has my paper already. Okay. [0:27:01, 0:27:08]: I'm actually here to speak on a different matter. So my only concern with this change would be that we've been promised [0:27:10, 0:27:14]: Exponentially, verbally, and in writing for a long time. [0:27:15, 0:27:28]: Um certain businesses I don't think any of us would be opposed to an yet another hotel not showing up, but the businesses that are committed, obviously Costco's not coming out of this mess because they've already started construction. [0:27:29, 0:27:31]: But Sprouts was committed to come and [0:27:31, 0:27:46]: You know, we were kind of interested in a sprouts something for this community as a whole, we would like to have better amenities in the in the stores where we would make our purchases. We already have Kroger's and Publix and Walmart. [0:27:46, 0:27:51]: But the Trader Joe's or the Sprouts variety of things, um, whole foods type of situation. [0:27:52, 0:28:06]: Many, many residents are asking for those types of products in in our it's so that we can make our purchases from those companies. So if this plan is changing the commitment of any of those vendors. [0:28:07, 0:28:08]: I think it [0:28:09, 0:28:11]: should be further discussed. [0:28:12, 0:28:13]: Sprouts is coming. [0:28:13, 0:28:20]: If if I may, and I I I I probably didn't do as good a job as I should have. [0:28:20, 0:28:32]: But no, uh to let everybody know, Sprouts is coming. Uh Sprouts uh as a matter of fact, I can give you a rundown right now th of what we expect uh to have out there right now. At present Sprouts is coming. We've got the [0:28:33, 0:28:45]: You've probably read about the new Chick-fil-A model that's coming in. That'll be the first one in the country. It's gonna be there. And you've got Starbucks, you got Chipotle. Uh you've got Whataburger, which would be the first one here on the south side. [0:28:45, 0:28:49]: Uh we got simple salad, uh we've got a bank coming in. [0:28:50, 0:28:53]: Uh Bahama Breeze is coming in. Um [0:28:53, 0:29:13]: We've got two other restaurants that we're talking to that we we feel like is going to be coming in also. So um I and I and I apologize, I probably should have been a little bit clearer to everybody, but Sprouts is definitely coming in. They've we've already committed and we'll actually start construction on Sprouts probably this in the next two two to three weeks. Um and so [0:29:13, 0:29:19]: Yeah, nothing has changed from what we have said. All we have done in this whole modification is actually just [0:29:19, 0:29:34]: taking the residential and shifting from one area to another to to actually make better sense where it flows better for the commercial development. As far as the hotel, there will be instead of having two hotels, you're gonna have the first twelve story hotel in this county. [0:29:35, 0:29:55]: Um it will be the you'll have the um it's more of a condo hotel. You'll have the bottom four floors will be your hotel, the fifth through tenth floor will actually be condos and the eleventh and twelfth floor is office space, so there will be a rooftop bar with a rooftop restaurant. And we expect to brand that with a [0:29:54, 0:30:14]: a very brand name steakhouse and a name that everybody will recognize. So um we are dedicated a and l and just for the record, I I I need to tell everybody this. I've been here, I've lived in this county all my life. I've lived matter of fact right here with City Hall sitting, is where I was raised and born at. And we sold three of our property to the city [0:30:14, 0:30:25]: To build City Hall. So my family's been here since the government gave land grants. I've got the original land grant that he's signed by John Quincy Adams, and my family was given the property here in Henry County. [0:30:26, 0:30:36]: We're one of the largest landowners in Henry County and I I'm proud to say that I'm from this county and I and quite frankly I want this to be a nice development. And so I hope my neighbors realize [0:30:36, 0:30:43]: the efforts and time we've put into this has not been easy. And we're going through COVID and with the changes we've had to go through. [0:30:44, 0:31:02]: Um it's been exceptionally hard, but I can assure'em this much that when we get through it, it's gonna be a nice development. It's not gonna be what you typically see in Henry County. So there's gonna be some different stores you've seen and different restaurants that we don't have here on the South Side. And we're we're making an effort. We could have already sold this out [0:31:02, 0:31:20]: um to the standard stuff you do see and we're turning out a lot of vendors because we want something to be a little different here. And so I hope when we get through I can stand back up here before you and I'll tell you that the sprouts that everybody's want we want the same thing. I that's something I totally agree with her. And so um [0:31:21, 0:31:30]: I I think what I want everybody to understand is we're we're not here for a rezoning and the promises we made they're still in place. They're not gonna change. All we're simply asking for is [0:31:31, 0:31:34]: The senior housing and the way this thing was rigid designed [0:31:35, 0:31:37]: Would have been in a different area. [0:31:37, 0:31:46]: The senior housing developer that we've met with has asked that look, they would rather the seniors would rather be across the creek where it's not as busy and you've got that wooded buffer between'em. [0:31:47, 0:31:56]: And you know, a and it made sense to us. You know, I I think that perfectly makes sense. Whereas your your your parlor's and your townhouses and your villas back behind it here [0:31:57, 0:32:05]: There's it's a different type group. And so all we're asking to do is just shift things around a little bit. We're not asking for any more than what we've already been approved for. [0:32:06, 0:32:26]: So let me suggest something to you. Uh people seem seem to be concerned about who's coming in and what uh uh businesses are going to reside there. Um if you get an opportunity, what I would do is I would post the businesses tentatively coming so there'd be no question about who's there. And so you [0:32:25, 0:32:36]: you wouldn't have this conflict about whether or not Sprouts or any other entity is coming in because it'll be posted, Hey, we've got this is a done deal, they're coming. It's a matter of construction. [0:32:37, 0:32:57]: It it is and and and and Mr. Chairman, you're absolutely correct. When we're when when we are actually allowed to do so, I promise you we'll be it will be posted like a a crow sitting on this on a on the set to crow his morning uh call. Uh a lot of these when they come in when you when you first strike deals with them, we're under an NDA where a lot of times we can't. [0:32:57, 0:33:04]: Can't talk about what's coming in. And and it's unfortunate, but in this co in the corporate world, the way it is and way it's structured. [0:33:04, 0:33:08]: Um we we're not allowed at times to talk about to a certain point. [0:33:09, 0:33:20]: And so but now once that happens and I can tell you that uh with Sprouts, I'm I'm able to tell you tonight that Sprouts is coming in because I we finally got everything inked done and and it's uh um [0:33:21, 0:33:28]: that's a certain deal that that will be coming. So I can talk about that tonight. Okay. So uh no sir, but I but I can assure you [0:33:28, 0:33:29]: Um [0:33:29, 0:33:43]: When we find there there's some details coming that I'm excited about and I promise you i um I think uh um it will be well known uh when these happen and I and I certainly appreciate your time. Okay, thank you. Yes, sir, thank you. [0:33:47, 0:33:56]: Is there anyone present who opposes I mean who supports the project? We've heard from the po pipa uh in opposition. Is anyone here who supports the project? [0:33:59, 0:34:01]: Any comments from the sir? [0:34:05, 0:34:07]: Have you fill out a uh a form? [0:34:10, 0:34:12]: Approach the uh podium. [0:34:22, 0:34:31]: Please provide us with your name and address, please. Sure. My name is Robin. Would you speak so we c so we can hear you? Sorry. Step closer to the mic to your to your left. To your left is a mic. [0:34:31, 0:34:51]: Thank you. Much better. Um, my first name is Robert. My last name is Lopez. Uh I reside at eight five one Chase Trail, McDonald, Georgia, three oh two five three. I believe me in Stockbridge for about twenty eight years. Pull the mic closer to your mouth, please. Yeah. I've been residing at um Stockbridge for about twenty twenty-eight years. [0:34:51, 0:35:11]: And I'm glad to say I'm also a senior now as well. And I welcome the project as presented today. And I'm so happy to see the new source coming into the area. So I don't have to travel elsewhere. So I appreciate that very much. Um there's other things I want to talk about, but not specifically on this particular traffic, so I can [0:35:11, 0:35:14]: I would like to come back and talk about the as well. [0:35:15, 0:35:17]: All right, thank you. Thank you, sir. Thank you. [0:35:21, 0:35:23]: Any comments from the uh commissions? [0:35:25, 0:35:26]: Commission comments. [0:35:28, 0:35:32]: Mr. Lopez, did you fill out a sheet? We don't seem to have it here. [0:36:07, 0:36:10]: Anyone else? Yes, ma'am. [0:36:20, 0:36:40]: Good evening. My name is Kaisha Holmes and I reside at 124 Eagles Crest Lane in McDonough, Henry County. I've lived there for 17 and a half years. Um, retired from the military and plan to finish paying for my home and stay in Henry County. [0:36:39, 0:36:43]: County. But so my concern, I don't think that um [0:36:44, 0:36:59]: A lot of people here are concerned with the vendors necessarily that are coming as long as like sprouts in them are coming. Um for me it's about the traffic that it's gonna bring. We only have one way traffic. [0:36:59, 0:37:05]: Um, on Jodico Road. Are they planning to do anything with the roads to make that better? [0:37:08, 0:37:11]: The applicant will approach the podium, please. [0:37:14, 0:37:15]: That's actually a great question. [0:37:15, 0:37:35]: Uh y yes, as far as the roads, there there'll be a four-lane that if you'll notice there's gonna be the what's called the West Parallel Connector. It will connect all the way from Jonesboro Road all the way up to Eagles Landing Parkway. It's a four-lane that's gonna be going through. It's a state project. Now we've put our portion of it in already, and it will tie in and come back out on the [0:37:35, 0:37:55]: Jonesboro Road all the way through to Eagles Landing Parkway. And if you'll notice the way ours is designed, ours is is really designed for traffic flow. And we've got uh probably another right-in, right out we're gonna have, or right out we're gonna have. But uh, but that is that you'll see there is a four-lane that's gonna go all the way from Jonesboro Road to [0:37:55, 0:37:59]: Eagles Landing Parkway on the west side. Thank you. [0:37:59, 0:38:19]: So um when is the road work supposed to get started? Yeah. Well our our portion from uh from from our property from uh on Jodico all the way up me from the south end of our property, which is um I guess right there at the church, up to Jodico, we just finished paving the last section of [0:38:19, 0:38:22]: that uh day before yesterday. [0:38:22, 0:38:38]: So our portion is gonna be ready. You know, we we we've got a red light going in there at Jodico, we got a red light going in intern internally on our property as well. And then you've got the wet go road what we call uh Argento Drive that goes east and west through the property that that actually also um [0:38:39, 0:38:42]: connects over to um Chambers Road. [0:38:42, 0:39:02]: as well. So we've we've made this where it's gonna help eliminate a lot of that traffic in these congested areas. Um and I I think if you see the road plan, road design, uh we were commended by Goethe uh for the road design work we had done on this thing. And it was we spent a lot of money on the traffic studies as well. Now the four lane going north [0:39:02, 0:39:22]: of from our from Jodeco to Eagles Land and Parkway, that's being the acquisitions of that are being acquired as we speak. And I think they're they're planning on starting construction on that next spring. And so and then from our south of our property to Jonesboro, there's already a two-lane road there. And that will be widened to a four-lane as well. [0:39:22, 0:39:27]: I think it also starts at about the same time frame next next year. Okay. Thank you. [0:39:29, 0:39:29]: Sorry. [0:39:30, 0:39:50]: One more question. Um, so I understand the roadway stuff, but um what about the fact that we already have like two new um townhome complexes, if you will, at each end of Jodico right now, and they're proposing to put [0:39:50, 0:39:51]: Yeah. [0:39:51, 0:40:11]: Is that right? They're putting up more townhomes, um, multifamily homes. Which is gonna bring more people, which nobody's moved into those new town homes at each end of Johtocote so far that I'm aware of, which is already gonna be added traffic plus [0:40:11, 0:40:21]: than the ones that you guys are building, that's even more traffic. Even with the new road work, it's still gonna be excuse my French. [0:40:21, 0:40:29]: Oh, I'm sorry. It's still gonna be crazy in our our neighborhoods and I for one won't be able to get to work. [0:40:30, 0:40:38]: Thing is, I think he he's pointed out that there will be traffic regulations there. And so I'm sure the traffic study has taken that in consideration. [0:40:40, 0:40:42]: Okay. [0:40:43, 0:40:43]: Right. [0:40:48, 0:40:49]: Anyone else? [0:40:50, 0:40:51]: Time has expired. [0:40:58, 0:41:00]: Commission members, any questions? [0:41:02, 0:41:04]: Any questions? May I have a motion. [0:41:05, 0:41:10]: Mr. Chairman Dave Planchon, I'd like to make a motion we accept this project as submitted. [0:41:11, 0:41:12]: Yeah, a second. [0:41:12, 0:41:14]: Harold of second. [0:41:15, 0:41:22]: It's been moved and seconded. All those in favor, let it be known by the sign of aye. Aye. Aye. Those opposed, ayes have it. The motion is carried. [0:41:23, 0:41:34]: Mr. Chairman, can you please go back to item number seven, please? Sure. And uh Mr. Chairman, before we move forward, I do have one request. Is it possible for us to get a copy of that traffic study? [0:41:40, 0:41:41]: Thank you so much. [0:41:44, 0:41:46]: Yes, we are, ma'am. Ma'am, you have you out of order? [0:41:51, 0:41:59]: Final plot approval for town houses at the Bridge of Jodico Development Council District Five to presented by community development staff. [0:42:02, 0:42:03]: So this is the [0:42:06, 0:42:10]: Um this is the copy of the plat. [0:42:15, 0:42:16]: Yeah. [0:42:26, 0:42:28]: That's the uh copy of the uh townhomes. [0:42:35, 0:42:40]: Ma'am, you have it or you can't you have to decide. [0:42:41, 0:42:45]: That's the town. These are the uh towns that are featured in the plat. [0:42:50, 0:42:52]: This is our in an approved project. Um [0:42:54, 0:43:02]: This is our in an approved project, Chairman Abdullah. Uh it's just bringing this before the uh Planning Commission to get the Planning Commission's recommendation. [0:43:04, 0:43:06]: Plat for the the townhomes of Johtoco. [0:43:12, 0:43:21]: It's part of the original plan that you just approved. So they we didn't have any text when I first called it out. Go ahead. We we went again. All right, go ahead. [0:43:24, 0:43:26]: Pull it. [0:43:26, 0:43:27]: Uh [0:43:29, 0:43:30]: Just [0:43:31, 0:43:35]: Is the applicant here when you're talking about the easier art we don't come up and talk? [0:43:38, 0:43:45]: for clarification for the for the uh audience, this is part of item eight really. [0:43:46, 0:44:06]: It it is. It is, Mr. Chairman. This is just the the the this has already actually been developed, the roads and all are in. This is actually just for the plat approval uh from the board that we have the process we have to go through. We're not asking for any more. That's uh this is already built. I mean, as far as the infrastructure, excuse me. The roads and infrastructure are already in. [0:44:08, 0:44:14]: So this is here just for approval. Yes, sir. Just for plan approval sorry, plan approval. [0:44:20, 0:44:26]: This is um part of eight that we've discussed already. [0:44:27, 0:44:27]: Yeah. [0:44:31, 0:44:47]: It's in council district five. Uh we've discussed the modification, the changes in the configuration of uh the plot. And this is simply an aspect of it. And so I'd ask for a motion from council members. [0:44:48, 0:44:49]: Mr. Chair. [0:44:49, 0:44:54]: I'll make a motion that we accept the final plat approval for the townhomes at Bridges at Jotaco. [0:44:56, 0:44:59]: You provide Miss Logan with your name? I don't know. [0:44:59, 0:45:00]: Uh Jaden Williams motion. [0:45:01, 0:45:06]: Okay. Second. And I'm Harold, I'll second it. Did you get that, Miss Logan? [0:45:08, 0:45:17]: All right, it's been moved and second. All those in favor, let it be known by the sign of aye. Aye. Aye. Those opposed? Ayes have it. Motion is approved. [0:45:20, 0:45:27]: Uh next item on the agenda is item nine, rezoning case number RZ two oh two three-two council district four. The applicant proposes to develop a subdivision with sixteen single family detached lots with amenities on the properties located at two hundred and fifty eight and two hundred and sixty four Valley Hill Road. The subject property contains about seventeen point zero six acres of land and is comprised of three parcels. [0:50:39, 0:50:59]: 258 and 264 Valley Hill Road has single-family residential homes, while the larger parcel is mostly wooded. Although the RR zoning district for 258 Valley Hill Road and a larger parcel larger parcel does allow two single-family detached lots, the applicant will not be able to build a number of lots. [0:50:59, 0:51:04]: lots under subject property due to the requirement of the lot air which is one to three acres. [0:51:05, 0:51:25]: The current zoning of C1 neighborhood commercial on 264 Valley Hill Road does not allow residential uses. Therefore, the applicant is requested to rezoning up the three parcels from RR Rural Residential and C1 Neighborhood Commercial to SR suburban residential. To allow for the subdivision to be built, the existing [0:51:25, 0:51:32]: Process will need to be combined. Thus, the applicant has requested the recombination plat of RC 2023-01. [0:51:35, 0:51:45]: And right before you, these are the amenities. That's the detention pond. That is the common area. And the two pick a ball course and they also have a walking trail as well. [0:52:15, 0:52:20]: And this another rendering of the that the applicant has provided as well, of the housing. [0:52:26, 0:52:46]: Staff analysis consistency with the comprehensive plan. The Stockbridge Future Land Use Map of the City's Adopted Comprehensive Plan twenty nineteen twenty thirty eight shows that the subject property's future land use designation is low density residential, which allows a density of one point two five to two units per acre. The density of [0:52:46, 0:53:06]: Of the proposed subdivisions is one unit per acre, which is consistent with the required density. Page 44 of the Stockbridge Comprehensive Plan states that the intent of the low density residential future land use destination is intended for typical large lot residential subdivision developments. In addition, the low density residential future [0:53:06, 0:53:26]: Land use designation provides a list of permitted zoning districts that are allowed, which includes the SR zoning district. The proposed subdivision is consistent with the policy goals of the current City of Stockbridge Comprehensive Plan 2018-2038 that are listed as follows on page 35 and 39, which is in this table. [0:53:27, 0:53:37]: Provide a mixture of housing options to attract young professional singles and small families and maintaining a family friendly environment focused on attracting and retaining young adults. [0:53:41, 0:54:01]: Staff analysis the relation that the proposed rezoning amendment bears to the purpose of the overall zoning scheme with due consideration given to whether or not the proposed change will help carry out the purposes of the City of Stockbridge zoning code. The proposed amendment rezoning to rezone the property from R R Route Residential [0:54:01, 0:54:15]: NC1 neighborhood commercial to SR suburban residential is acceptable since the intent of the SR is to provide for single family dwellings of a low to moderate density character on individual lots. [0:54:18, 0:54:38]: The potential positive effects of the rezoning amendment on the character of the proposed zoning district, a particular piece of property, neighborhood, a particular area or community. The proposed rezoning will allow the property to develop in a type of use that is more compatible than the other type of permitted uses that are allowed under the subject property C1. [0:54:38, 0:54:58]: And RR zoning classification due to the presence of other subdivisions that are located within the vicinity of the property, which are Springwood Valley, which is zone SR commercial, and Kinsey Crossing, which is zone SR suburban residential. In addition, there are other single-family residences that are zoned SR. [0:54:58, 0:54:59]: Suburma residential. [0:55:02, 0:55:22]: The physical conditions of the site relative to the capability to develop as requested include the topography, drainage, access, and the size and shape of the property. The revised plat the applicant provided shows that the proposed subdivision will be compatible with the physical features of the subject property. The revised plat shows that the attention pile will be located northwest. [0:55:22, 0:55:26]: of the subdivision. The proposed subdivision would include a pool, [0:55:27, 0:55:38]: Club house two pickleball courts with ten pocket spaces, a common area three point si three point nine six acres, a walking trail and a dock park as shown. [0:55:39, 0:55:50]: The impact upon the adjacent property owners should the request be granted. [0:56:09, 0:56:23]: the impact of the proposed amendment on adjacent thoroughfares and pedestrian and vehicle circulation and traffic volumes. The applicant did not submit a traffic study and as a result, Stam is unable to comment on the overall impact the proposed subdivision will have on the assistant role. [0:56:24, 0:56:35]: Valley Hill Road. In order to prevent traffic backup on Valley Hill Road and to facilitate turning movement, the developer has propo prof has provided turning lanes as shown that proposed at, which is shown right here. [0:56:40, 0:57:00]: The merits of the requested change in zoning relative to any other guidelines or policy for the development which the Planning Commission and City Council may use in furthering the objective of the comprehensive plan. The approval of the requested rezoning will allow the subject property to develop similar to the subdivisions that are located in the vicinity of the air area. [0:56:59, 0:57:08]: An application for the land experiment permit, application for the pro subdivision, as well as building permit applications are required by the city. [0:57:09, 0:57:29]: The ability of the subject land to be developed as is presently zoned. The applicant has requested that 264 Valley Hill Road be rezoned. Although the parcel is currently zone C1 neighborhood commercial, it is less likely that it will be developed for commercial uses due to the location of the parcel in a residential area. The applicant has requested that other parcels. [0:57:29, 0:57:41]: parcels be rezoned to SR suburban residential. Since there are other surrounded SR zoning districts in the vicinity of the area, the most appropriate use for the subject property is single family residential. [0:57:45, 0:58:05]: Staff recommendation. Staff recommends approval with conditions for the proposed rezoning from RR Rural Residential and C1 neighborhood commercial to SR suburban residential. The recommended zoning conditions are listed below. The subdivision will be developed in accordance with the City of Stockbridge Development Code and the site development standards and requirements. No land disturbance or building permit shall be issued for the subject property until the applicant has had the new recombination plat officially recorded and has submitted a copy of the [0:58:25, 0:58:27]: of the recorded plots of the community development department. [0:58:47, 0:58:53]: And this is the zoning district requirements for the SR for the SR suburban residential. [0:58:56, 0:58:59]: And this is section four point four two of the Unified Development Code. [0:59:02, 0:59:03]: And that's the presentation. [0:59:05, 0:59:08]: We have an applicant present. Yes. [0:59:27, 0:59:40]: Thank you for this time. My name is Julian Selby. Uh close to the mics and restored Vision Construction Group. Uh like to thank the chairman and officers and board for allowing us to have this time to present this application for rezoning. [0:59:43, 1:00:03]: Uh, I wanted to clarify that the uh we wasn't able to connect to a SOAR, have annex, so each property is gonna have its own uh septic and this is why it's only fifteen houses in a clubhouse instead of uh more you know, the first thing we was trying to do was townhouses, but that was not gonna be [1:00:03, 1:00:23]: beneficial to what we were dealing with. So we've decided to do this um this plan here consisting of 15 houses of um modern and contemporary style, um executive estate, um gated community uh with its own clubhouse. [1:00:23, 1:00:40]: uh gym, uh swimming pool and um other facilities, you know, with the gated community is gonna offer security uh for the this development in the city of Stockbridge. I believe it may be the first of its kind, as far as a gated community like this. And um [1:00:43, 1:00:58]: Each house on the um each lot will be different. Um every lot is uh not the same, so it's not gonna have your typical cookie cutter look. Um it's going to be more of a a custom executive uh development. [1:01:07, 1:01:08]: Any questions? [1:01:10, 1:01:11]: Questions from Commission? [1:01:13, 1:01:14]: I have a question. [1:01:16, 1:01:18]: Why are you going with subtle tanks? [1:01:19, 1:01:39]: We tried to um we tried to uh see if we could annex uh to the closest um developments and I believe it was a church that was too f you know far away to be able to hook up to the source system. We've been through the Henry County and the waters sort of trying to make this happen. [1:01:39, 1:01:46]: And I think through all the different studies that we had, we was not able to connect. So we uh went this direction. [1:01:53, 1:01:55]: It's kinda interesting, you know, because uh [1:01:56, 1:02:00]: I would think that the infrastructure would allow for you to connect. [1:02:00, 1:02:20]: I mean when w when you're developing something like this, uh I think the first thing you want to look at is the infrastructure, that is water, sewage, electricity, et cetera. You get those things lined up before you really start talking about development. I don't see let me get finished. I don't see separate [1:02:20, 1:02:31]: septic tanks being very viable long term. And uh historically certainly you're gonna have some issues with septic tanks. [1:02:33, 1:02:53]: Um like I said before, we did go through the um what we had to go through to see if we could connect to the SOAR. Um and I believe that everything that we went through we were told that we could not. And there was no way that we can connect to a SOAR system in that area, um w without getting approval, which [1:02:53, 1:03:03]: One is the HOA they didn't want to approve as far as we have to annex or ask to get into there. It just it wasn't viable at the time. So we did want to connect. [1:03:04, 1:03:06]: But we were told that we could not. [1:03:07, 1:03:27]: Um the source system, I mean the uh septic systems that we are using is not like your traditional septic systems. Um most will have a pumping system and a backup with it. The houses are has been significantly sized to and with the bedrooms and bathrooms allowed that will have a viable septic system that will [1:03:27, 1:03:47]: Requires cleaning every three years. That cleaning ranges with the company that we'll be putting them in is also be the servicer of those units. Cost to that is about$150 to$175 to maintain and clean it. The renewal [1:03:47, 1:03:57]: or replacement can happen every 30 years uh uh before it may have to be uh picked up and um reestablished and put in. [1:03:59, 1:04:00]: Yeah. [1:04:01, 1:04:06]: We are using concrete, um concrete tank units as well. [1:04:10, 1:04:30]: All right. Uh you have anyone who supports or oppose this if you support it or oppose it. Mr. Chairman, I I have a question. So for the gentleman. Um I didn't hear or I didn't understand the water authority rejected your request. No, the water uh authority did give us uh [1:04:29, 1:04:45]: I think it was what Henry County gave us a letter of approval as far as providing the water, but they could not do the the soar. We couldn't hook up to the sewer. But there's sewer running up and down Valley Hill Road. I wonder why that was. [1:04:50, 1:05:06]: Um, we've really went down that road to try to get this done any way possible because it's actually better for the owners to have this to t to have this to have a bigger, you know, housing on this. But everywhere we went we hit a dead end. We couldn't do it. [1:05:07, 1:05:21]: Okay. You could always what they call dry plum the house with a septic tank, eventually to tie it into the sewer system once it comes down the street, so to speak. Um maybe something you want to consider. [1:05:22, 1:05:42]: We did consider that and that actually will be in the blueprints to have an um a hookup when that hopefully when that time comes that we can discontinue with the um de septic system. It will actually have another pipe hit it on in front of each house. It'll just be capped off. And as soon as [1:05:42, 1:05:48]: As soon as that is allowed, we can run that right down a block and connect to the uh uh the street that's going by. [1:05:52, 1:05:53]: That it? [1:05:54, 1:06:11]: That's it. Oh, one more thing on a septic. Just uh they will also they the kind that we are going to get has filters, breathing filters. So there's no smell, things like that. The breathing filters will have to be replaced every six months or washed out, but the company would do that as well. [1:06:13, 1:06:13]: Okay. [1:06:15, 1:06:23]: Okay, uh public comment. Those who support or oppose it have you fill out an application and approach the podium. [1:06:25, 1:06:27]: All those who support, do you support it? [1:06:28, 1:06:30]: You support it, ma'am? [1:06:31, 1:06:33]: We have anyone supporting the project? [1:06:35, 1:06:36]: Those opposed. [1:06:37, 1:06:38]: You first, ma'am. [1:06:43, 1:06:50]: So am I correct in saying that this was IO eight or Miss approach the podium, give us your name and address. [1:06:50, 1:07:00]: Connie Snow, 426, Chase Marion Way, McDonough, Georgia, 30253. Am I correct in saying this is item eight and nine on the agenda? [1:07:01, 1:07:11]: We're on That's what you had said earlier. I'm just making sure I'm clear. We're on nine. We're nine. So my question is, is why is it not listed on our agenda? So we are prepared. [1:07:12, 1:07:12]: Well it's what? [1:07:12, 1:07:16]: It not listed on our agenda so that we are prepared. [1:07:25, 1:07:29]: You don't have rezoning a valley here on your agenda? [1:07:29, 1:07:31]: No, I only have items one through seven. [1:07:34, 1:07:36]: And so does everybody else here, correct? [1:07:38, 1:07:39]: One through seven. [1:07:39, 1:07:39]: Yes. [1:07:40, 1:07:51]: So it's hard to be prepared and be informative when you're not given all the facts so that you can research it and be prepared. That's all I need to say. And I just want to make sure that it's recorded for the record. Okay, thank you. [1:07:57, 1:07:58]: Did you fill out a a form? [1:07:59, 1:07:59]: I guess it. [1:08:00, 1:08:01]: Okay, we'll make sure. [1:08:02, 1:08:18]: Hi, my name is Susan Groven. I l speak a little louder. Speak a little louder. My name is Susan Grovener. I live at three ten Valley Hill Road. Um my property is the largest amount of property that is adjacent to the proposed subdivision that's being put in. [1:08:20, 1:08:20]: Um [1:08:23, 1:08:33]: The I I never received a letter. Um d I know now why I never received a letter like this that [1:08:34, 1:08:38]: Anne was so graciously to give to me. Um [1:08:39, 1:08:48]: The houses that are going in and everything, the reason why is be the septic tank issue is it's a mound of rock. [1:08:48, 1:08:48]: I mean. [1:08:49, 1:08:51]: It's a mound of rock. [1:08:51, 1:08:55]: When the subdivision went in back behind our property. [1:08:56, 1:09:03]: The amount of blasting that they had to do just to put those houses in affected the structure of my house. [1:09:04, 1:09:17]: They're gonna have to blast to get these houses put in. I know what my property is. I know what the subdivision. I've walked that property I don't know how many times where they're talking about putting the houses. [1:09:18, 1:09:19]: Um [1:09:20, 1:09:22]: Another thing is [1:09:23, 1:09:31]: The Hor Historical Society has come out to my property. Um, there's there's soldiers that are buried on the property. [1:09:32, 1:09:36]: There's soldiers that are buried on our property. [1:09:36, 1:09:54]: And I believe that there is also soldiers that are buried on the property that they're proposing to build the houses on. Our road is so congested as it is. Whenever a train comes, it backs all the way up the hill to North Davis Road. [1:09:55, 1:09:58]: I can barely get out of my driveway. [1:09:58, 1:10:06]: without having to just floor it as it is. Adding more traffic to that is gonna be ridiculous. [1:10:07, 1:10:08]: Um [1:10:09, 1:10:10]: Ди [1:10:11, 1:10:17]: The the map that I just received that I just saw about less than an hour ago. [1:10:22, 1:10:25]: It's going to put [1:10:26, 1:10:27]: My property [1:10:28, 1:10:30]: And a f it's gonna flood my property. [1:10:32, 1:10:33]: All of the runoff [1:10:34, 1:10:36]: It's gonna go like this right here. [1:10:37, 1:10:38]: And it's gonna be on my property. [1:10:40, 1:10:47]: As far as the dog park, the swimming pool and the clubhouse and everything else. [1:10:47, 1:10:49]: That's right next to my creek. [1:10:50, 1:10:53]: I've got a natural spring on my property. I've got two of'em actually. [1:10:54, 1:10:57]: And that's gonna run straight into that creek. [1:10:58, 1:11:01]: The wildlife that I have lived and [1:11:04, 1:11:04]: Uh uh uh [1:11:08, 1:11:10]: I think you cut it off. Tap it. [1:11:13, 1:11:17]: Okay. I've lived here for twenty three years. [1:11:18, 1:11:21]: I don't wanna have to up and move. I don't. [1:11:22, 1:11:24]: I I was born in Stockbridge. [1:11:25, 1:11:26]: I love this town. [1:11:27, 1:11:28]: Have all my life. [1:11:29, 1:11:37]: But to have seventeen, sixteen, seventeen houses right in my backyard, I'm talking it's gonna be within [1:11:38, 1:11:42]: I'm not good at distances or anything like that. [1:11:42, 1:11:46]: But it's probably gonna be fifty yards away from my home. [1:11:48, 1:11:50]: I know development. [1:11:50, 1:11:53]: is a natural thing. I do. [1:11:53, 1:12:04]: I just don't think that this suits what they're wanting to put on to affect so many other people. Um [1:12:06, 1:12:10]: Uh y I just think that it's just not [1:12:11, 1:12:13]: It it's not a good move. [1:12:13, 1:12:20]: Let me ask you this, has the developer been out to speak to all the computer. [1:12:21, 1:12:26]: There is a reason because what they're trying to do here is gonna destroy my house. [1:12:27, 1:12:29]: Литерли дестрой майонез. [1:12:30, 1:12:38]: I have cracked foundation and stuff from them putting in the two hundred and fifty houses back behind me. [1:12:39, 1:12:46]: I had to go down to the construction company and get them to replace some of the stuff that fell off my wall whenever they were blasting. [1:12:47, 1:12:51]: You're more than welcome to come to my property and see the amount of rock that we have. [1:12:52, 1:12:55]: That's probably the reason for the septic tanks. [1:12:57, 1:13:03]: Um, I wasn't aware. I thought everybody was on septic tanks on Valley Hill Road. [1:13:03, 1:13:04]: Adead. [1:13:05, 1:13:06]: Um [1:13:08, 1:13:11]: I I don't like it. I don't want it. [1:13:13, 1:13:14]: Saved my house. [1:13:15, 1:13:20]: That's I appreciate your time and I appreciate your consideration, but this is [1:13:21, 1:13:28]: Upset me to my core finding out all of this thirty minutes before I walked into this place. [1:13:30, 1:13:36]: To not be contacted, to not a letter be sent or anything. [1:13:36, 1:13:49]: And all I see is a public hearing notice on a sign that is this big driving thirty-five miles an hour down the road that you can't read. Chairman, we've reached the time. All right. You can call. I appreciate your time. [1:13:49, 1:13:54]: Also, we're only required to send a notice with people within three hundred feet. [1:13:56, 1:14:00]: My property is the biggest adjacent property. [1:14:02, 1:14:07]: Ma'am, you're out of order for this. Let me let me finish this up, okay? [1:14:07, 1:14:07]: Had [1:14:10, 1:14:12]: Anyone else who opposed the project? [1:14:12, 1:14:21]: Mr Chairman, the Mr Chair Speaker's address, uh she may have been talking about a different case. Her speaker's address is near Holloway Road. [1:14:21, 1:14:23]: Not the case that we're talking about right now. [1:14:25, 1:14:29]: No. Valley Hillbrook? You're talking about Valley Hillbrook. [1:14:30, 1:14:38]: Three ten Valley Hill Road, I've got about three quarters of a mile of property that adjacent Sir you have a lot of orders. [1:14:43, 1:14:44]: This is a formal meeting. [1:14:45, 1:14:47]: Let me ask you this. [1:14:47, 1:14:50]: We had a correct address that that she's referencing. [1:14:56, 1:15:16]: Uh while they clarify addresses, Mr. Chair, I did want to uh recognize the first gentlelady who went up on the mic. Uh she did say that it was not a uh agenda item on the on their agenda. However, it's just worded differently for us. For us, we see it as an action item. For them, if you go to public hearing number uh public hearing, it's [1:15:16, 1:15:26]: It's number two. It's item number two, which is what we're referring to. I have the public's agenda right here. Um and I will make sure the chair has this so he's aware uh with what you guys see as well. [1:15:55, 1:15:57]: Yeah, three minutes for rebuttal, sir. [1:15:59, 1:16:05]: Just wanted to address some of the concerns mainly about the water runoff. Um [1:16:06, 1:16:26]: The property will have a retention pond where the all the sores in the street and all that will be directed to. Each property also with the uh water runoff systems from the uh roof and the uh gutters and drains will actually go into a [1:16:26, 1:16:33]: in ground filtr inf filtration system to return the water back into its natural elements. It's not gonna be um [1:16:34, 1:16:54]: uh exited out just on the grounds for it to to to run off. So the only water when we were doing our best to control um water runoff. I go through this in the city of Brookhavens the same thing. So every house, every club the clubhouse, everything will have its own water filtration system. Every down [1:16:54, 1:17:14]: Will have will go down in the ground into that water filtation system. So um as well as the um the common street areas and all that will be directed to the uh retention pond system as well. The all the houses are gonna be on slabs. So we're not doing basements, we're not digging [1:17:14, 1:17:34]: Far that deep. And that's one of the reasons why I was talking about the septic systems having a pump system, so we don't have to go that far deep into the ground. But we did have soil tests where the septic systems are going to go. We don't have rocks or or hard. [1:17:34, 1:17:54]: Hard ground stones there in that area. This is why the houses are specifically a certain size and could not, you know, go completely on each property that is on the plat, as you've seen. So we were very careful with that. We don't like to blow things up and though sometimes it's necessary. [1:17:54, 1:18:13]: I haven't done it as of yet. I've been able to get things done with a uh power jack of heavy equipment without doing the dynamite thing. And um we're gonna do our would do our very best not to do it then. But we have took steps to protect surrounding areas from water runoff. [1:18:14, 1:18:22]: Let me ask you this. Did you um try to meet with the uh adjoining property owners to discuss your development? [1:18:23, 1:18:25]: No, I did not. Um [1:18:25, 1:18:45]: I know that the letters went out. I have no problem with meeting uh anyone. I have no problem with anyone receiving um my project manager's information. Um I have done this sort of thing before and and actually got a Zoom meeting together with folk, especially with the COVID thing going on, for them to [1:18:45, 1:19:05]: answers any QA's or any questions that they may um ask or have. I have no problem with um you know dealing with the residents around. And then this is just 15 houses. So I understand about the traffic and and the concerns of traffic with a lot of development going on. But how [1:19:05, 1:19:10]: This is fifteen homes and it's not a huge development here. [1:19:14, 1:19:25]: And you're saying there's not gonna be any blasting. Now you know, while you may not blast the use of heavy equipment, deck hammers and whatnot, that also impacts other people's property. [1:19:25, 1:19:31]: Absolutely. Blasting does a whole lot more. I understand that, but I'm just saying it's not that uh [1:19:31, 1:19:35]: your activity's gonna have a negative impact. It's gonna have an impact. [1:19:36, 1:19:37]: And for that reason [1:19:38, 1:19:48]: I was asking had you uh met with the joining property owners? No, I have not. I have not a problem. A lot of a lot of these issues can be resolved. [1:19:49, 1:19:55]: If you meet with the property owners in advance, let them know exactly what you're doing, give them um [1:19:56, 1:20:01]: A layout uh a model of what you're proposing and [1:20:01, 1:20:09]: how it's going to affect their property. Sometimes it could be an increase in the value of their property, but you won't know unless you engage in that kind of activity. [1:20:09, 1:20:11]: It is highly recommended. [1:20:11, 1:20:12]: For developers. [1:20:13, 1:20:14]: In advance. [1:20:15, 1:20:18]: To meet with the adjoining property owners є quick example. [1:20:20, 1:20:21]: I'm from Chicago. [1:20:22, 1:20:23]: And I did zoning in Chicago. [1:20:25, 1:20:27]: An applicant came before the council once. [1:20:28, 1:20:30]: And wanted to have uh um [1:20:31, 1:20:42]: Um God escaped me right now. What do you call it? Um where you dispose bodies burning. I can't think this word escapes me right now. [1:20:44, 1:20:47]: You understand me? The burning body. What is it called? What is that? [1:20:47, 1:20:48]: Cremation. [1:20:49, 1:20:52]: Wanted to build a cremation uh facility. [1:20:54, 1:20:57]: Uh on a major artery which was properly zoned could do that. [1:20:59, 1:21:03]: Okay. There was two ladies who came in. [1:21:06, 1:21:12]: And they made the statement that I don't wanna be baking a cake and smelling a body burn. Do you know what happened to that application? [1:21:15, 1:21:21]: I can imagine. Yeah, right. Mm-hmm. And so if you meet with the community in advance, [1:21:22, 1:21:26]: You can address all those kind of issues and concerns that they would have, i.e. [1:21:26, 1:21:32]: Is your activity going to destroy my property? What kind of impact it's gonna have on my property? What kinda [1:21:32, 1:21:37]: uh uh uh impact is you're gonna have on the traffic flow. A lot of these things can be mitigated. [1:21:37, 1:21:42]: may not necessarily resolve everything, but a lot of it can be mitigated. [1:21:42, 1:21:43]: If you take that step. [1:21:44, 1:22:04]: Um what you're saying is not foreign to me. I believe in it. I have done it before in a different way. Um I love meeting the people, especially around um a development like this that we're uh wanting to do work on. For one, security. I think that the neighbors who know who I am and also know who [1:22:04, 1:22:24]: know uh that have a contact with us if they have concerns or something that's going on that is affecting them and they can get in touch with me or mainly one of the project managers, it works well. Um also if they know that I am touchable, I'm not, I'm a small, as my wife say, boutique builder. I'm not [1:22:24, 1:22:44]: Adams homes or whatnot. I took and bought 21 lots in Spotty Village, which is a 55 and over gated community. Did the same things. Small, individual, but custom homes. But everyone knows me there. If something goes wrong, they know how to get in touch with me. They know how to call me if they see something strange. [1:22:44, 1:23:04]: Happening, they know how to call me. I do that as I get to know the people and things like that around there. Um for a project like this, we would have a tent. We would have a bigger sign that can be seen for information website and phone numbers for anyone to contact if they want to have or have some concerns. [1:23:04, 1:23:21]: or want to do a meet and greet. We do have different functions. I have done that before because it just I've had big equipment stolen before. And it's just easier when the community is looking out for you. But for that to happen, they need to also know that I'm looking out for them as well. [1:23:23, 1:23:25]: And so all of these houses are gonna be built on slabs. [1:23:26, 1:23:28]: All these houses would be built on slabs. [1:23:31, 1:23:31]: Okay. [1:23:34, 1:23:36]: Any questions, uh council members? [1:23:38, 1:23:42]: I have a question. Uh I'm I'm I'm a little bit disturbed because uh [1:23:42, 1:23:50]: You're speaking to me as though you have all this experience, but the question I would be asking, why hadn't you present yourself to the homeowners? [1:23:51, 1:23:59]: As far as their concerns are, I I don't think they should be running to you and when they have no idea who you are. [1:24:00, 1:24:20]: One of the things I need to find out when one to come to these meetings to find out if what we're proposing can work or do we have to do something else. Um when I do speak to the people around the area, I like to tell them exactly what we're going to do, what we're permitted or what has been approved, and not what [1:24:20, 1:24:40]: we're trying to do um also it's not I mean you just gotta be real careful before you just go in and knocking on people's doors and things and introducing yourself really careful these days. So we do do a meet and greet. We do put up a pop-up tent and a big sign and and also letters if people [1:24:40, 1:24:57]: people want to come by and want to engage with us, that is on a mutual agreement. Um but um I mean that's just how you know we we do it right now. The safest way to do it right now. I mean, I don't say that I can [1:24:58, 1:25:10]: Please every I try to uh make everyone happy. You're not. I try to make everybody at least comfortable, even though if they're not happy, at least they're comfortable w you know with me. [1:25:16, 1:25:17]: Okay, thank you. [1:25:25, 1:25:29]: Yes, ma'am. You have a an applic yeah you fill out a form, approach the podium. [1:25:41, 1:25:48]: Good evening and thank you for allowing me to speak. I have been a resident of High Lane Drive for th over thirty-six years. [1:25:48, 1:25:52]: I first provide me with your name and address. I apologize. My name is Susan Cosby. [1:25:53, 1:25:57]: And I live at one ten High Lane Drive, which backs up to this project. [1:25:57, 1:25:58]: Come closer to the mic. [1:25:59, 1:26:18]: This gentleman has stated that there will be no blasting in that neighborhood. However, he also stated that there will be a pool. My neighbors have had to blast to have pools put in their backyards. Henry County Water Authority had to come in with heavy equipment to replace the piping. [1:26:19, 1:26:21]: And when they bought [1:26:21, 1:26:24]: the water rights from Clayton County. [1:26:24, 1:26:44]: Because there is granite just one foot below the surface of the ground on High Lane Drive. So will there be blasting? Of course there will be. Will there be heavy equipment? Of course there will be. My house suffered structural damage because of the blasting of the 240 houses that are in the neighborhood behind which [1:26:44, 1:27:04]: where the proposed building is. He talks about that there will be pools, dog parks, walking track and everything. However, the pack people who have lived in this area for 10, 20, 30 or more years will not have access to that because it's a gated community. [1:27:04, 1:27:15]: But he's taking this neighborhood and put it right in the middle of where we live. He is building a neighborhood that will have [1:27:16, 1:27:20]: A turn lane on Valley Hill Road that is just below the crest of a hill. [1:27:21, 1:27:23]: That is a blind spot. [1:27:23, 1:27:38]: The traffic there already is horrendous. The cars come over that hill and they do not see when I'm turning left out of High Lane Drive. I have to go down old stagecoach road. [1:27:38, 1:27:42]: just to be able to get out without [1:27:42, 1:27:45]: Worrying whether I'll be hit or not. [1:27:46, 1:27:48]: The traffic from this neighborhood will hinder [1:27:49, 1:28:03]: even more because if they're turning left right at the top of the hill, I won't see them coming out of the neighborhood prior to me trying to turn left. I have seen this city grow. [1:28:04, 1:28:06]: I was a part of the county. [1:28:06, 1:28:08]: Up until November of this past year. [1:28:09, 1:28:29]: And we were zoned rural. Now he wants us to be zoned suburban. I didn't come to this area to be suburban. I moved here when there was just a couple of red lights. We'd like to have that area continue to be a nature area. [1:28:29, 1:28:33]: Where the deer and the fox and the coyotes [1:28:33, 1:28:37]: And the possums and everything else live because of the creek. [1:28:38, 1:28:42]: There's two creeks there, and his intention is to block them. [1:28:43, 1:28:46]: So that there's a retention pond? [1:28:46, 1:28:48]: That's not gonna benefit the n uh [1:28:49, 1:29:04]: Wildlife in the area that there is so little of at this time. The area is that is where the animals live. If he blocks these creeks, where are they gonna get the water from? Because that pond is gonna be fenced in. [1:29:06, 1:29:08]: The animals aren't gonna be able to get there. [1:29:08, 1:29:12]: And again, all of us who live around this area. [1:29:13, 1:29:20]: Will not have the benefit of seeing the wildlife. We won't have the benefit of the pool and everything. [1:29:20, 1:29:22]: amenities he's talking about. [1:29:22, 1:29:28]: Because it is going to be a gated community. And he says he's talked to the water authority. [1:29:30, 1:29:33]: If he's talked to him, he'll know that we can [1:29:34, 1:29:45]: have a problem with the water pressure as it is. We also have a problem with our water being orange, probably about once or twice a month, one time to the point [1:29:45, 1:29:51]: That I was taking a shower and the orange water dyed my hair. [1:29:51, 1:29:53]: I had to pay. [1:29:53, 1:30:01]: to get my hair fixed because of the water. And they told me it was because they were cleaning the lines. [1:30:03, 1:30:14]: Any additional residence is gonna put a strain on the system as it is and it needs to be addressed prior to anybody considering building in the area. [1:30:15, 1:30:20]: So I'm asking that you consider the things that I've stated before you vote on this rezoning. [1:30:21, 1:30:21]: Um [1:30:22, 1:30:29]: I think everybody who is sitting here in the auditorium tonight would agree with me that we have been here a long time. [1:30:29, 1:30:32]: And we have all just been annexed into the city. [1:30:33, 1:30:36]: And now we're having to pay the price of giving up. [1:30:37, 1:30:41]: That little bit of area that we felt was a little bit of nature. [1:30:43, 1:30:48]: We don't ha we won't have the creeks because the people behind the gated community's gonna be enjoying that. [1:30:49, 1:30:51]: We're gonna pay the price though. [1:30:51, 1:30:53]: The lack of water. [1:30:53, 1:30:54]: Pressure [1:30:55, 1:30:57]: The addition of traffic? [1:30:58, 1:30:59]: And possibly the nuisance of [1:31:00, 1:31:01]: Additional crime. [1:31:02, 1:31:04]: I am a victim of crime, said [1:31:04, 1:31:08]: Of an from an area that was built in just the past few years. [1:31:09, 1:31:11]: I had a gentleman who was renting. [1:31:12, 1:31:13]: A camper [1:31:14, 1:31:16]: In the backyard of one of those houses. [1:31:17, 1:31:19]: And he started stalking me. [1:31:20, 1:31:27]: He knew what time I got off work, and he was in my backyard when I pulled in my driveway at two AM. [1:31:28, 1:31:32]: He would sit in my backyard. Well I would sit on my porch and not know he was there. [1:31:33, 1:31:37]: And he would masturbate while having a machete sit beside him. [1:31:38, 1:31:40]: We don't need additional crime. [1:31:41, 1:31:42]: Time is up. [1:31:42, 1:31:43]: Thank you. [1:31:47, 1:31:48]: Anyone else? [1:31:52, 1:31:53]: Anyone else opposing the project? [1:31:56, 1:31:58]: That closes public comment. [1:32:02, 1:32:04]: Commission members. [1:32:05, 1:32:23]: Mr. Chairman, this is Dave Planchon. I have one thought kind of gnawing at me. Um sixteen homes are being proposed versus fifty to a hundred townhomes that could be potential on this piece of property. Which would we prefer? [1:32:38, 1:32:40]: Mr. Chair, may I make a comment? [1:32:40, 1:32:41]: Sure. [1:32:42, 1:33:02]: Well, one thing that uh the public is not told is that the decisions that we make here is not final. Even if even if we said yes or no, it's gonna be up to the city council to make the final decision to decide what's gonna be done when it comes to the city. [1:33:02, 1:33:03]: comes to the property. [1:33:06, 1:33:15]: Mr. Chairman, point of clarification. Townhomes may not be built on the property under the existing zoning, nor even on the proposed zoning. [1:33:21, 1:33:23]: So I'll just the zoning change. [1:33:24, 1:33:25]: Would you repeat that, Mr. Logan? [1:33:30, 1:33:39]: Of the property does not allow townhomes, and the requested rezoning also does not allow townhomes. [1:33:45, 1:33:50]: Correct. The existing zoning doesn't allow for what's being proposed. That's what we're up here trying to decide. [1:33:54, 1:34:14]: Existing zoning allows um single family houses by themselves but not a subdivision per se. That's why the rezoning is necessary. But you mentioned townhomes and no townhomes can be built unless the property is rezoned to M FR or PUD, which [1:34:14, 1:34:16]: Is not the subject of this case. [1:34:17, 1:34:20]: Right. That's not the zoning this gentleman is requesting. [1:34:23, 1:34:27]: He's requesting uh suburban suburban rule. [1:34:34, 1:34:38]: Mr. Chairman, I have a question for staff, please. Sure. [1:34:40, 1:34:45]: This property, to my understanding, was recently annexed into the city. [1:34:48, 1:35:00]: And I'm wondering, uh uh the the current zoning is to my understanding Henry County's zone in classifications. Is that correct? [1:35:03, 1:35:07]: And the proposed zoning is really to [1:35:08, 1:35:12]: Align with the City of Stockbridge is owning. [1:35:15, 1:35:17]: For similar uses, correct? [1:35:19, 1:35:27]: Not necessarily a z uh line. This is what the applicant is requesting in order to allow this subdivision to be built. [1:35:28, 1:35:30]: Well let me let me rephrase. [1:35:32, 1:35:41]: Henry County has a suburban a rule of residential classification. The City of Stockbridge does not. Is that correct? [1:35:44, 1:35:52]: A, which is residential agricultural, whereas uh city zoning is R R rural residential. [1:35:54, 1:35:57]: Okay, so we've already made the transition. [1:35:58, 1:36:16]: Well well the R R is similar to the county's R A, but one of there's three parcels on this property and one of'em um is zone uh C one for commercial. I'm aware of that and that that was I do that I was gonna inquire if you knew the history of why that is zone commercial. [1:36:17, 1:36:20]: Because it doesn't seem to be appropriate for the neighborhood. [1:36:23, 1:36:25]: Well it was on commercial a long time ago. [1:36:27, 1:36:30]: Right, I understand that, but I was just wondering if you knew why. [1:36:32, 1:36:51]: No, not exactly what's gone zone commercial. I guess where I'm going with this is that the rezoning case that bef that's before us seems to be appropriate. Seems to be the appropriate zoning for this part these two parcels in that area. [1:36:53, 1:36:55]: And for that reason [1:36:57, 1:37:15]: I would be inclined to support the support the rezoning case. I do have some concerns about and now that I've heard the presentation from the applicant and heard the public comments, I am concerned about [1:37:18, 1:37:31]: The rock, the separate tanks, the blasting or the what if it would take to in fact erect the subdivision and I guess I'm qu qu asking staff [1:37:31, 1:37:35]: They would they would have to go through the development phase and they would have to um [1:37:35, 1:37:41]: be in compliance with all cities re citi all the cities regulations as far as it concerns development, erosion. [1:37:41, 1:37:50]: uh the the hours in which they can bill and um if they use dynamite to bless they will have to be in in compliance with the city's ordinances [1:37:50, 1:38:02]: So voting for this rezoning is just to really get the the correct rezoning, the proper zoning for that parcel. Um [1:38:04, 1:38:09]: But to actual build on it, there's some other steps that you guys would have to [1:38:10, 1:38:26]: Yes, I'm not sure. Supervise, if you will. And and and typically I rely on staff most of the times because you're the professionals, you're the experts. They would have to go through the development play uh the development phase and we have some really stringent criteria. [1:38:26, 1:38:28]: That they will have to adhere too. [1:38:29, 1:38:31]: Okay. [1:38:32, 1:38:35]: Okay. All those issues will be taken care of in the [1:38:36, 1:38:40]: I would encourage the applicant um [1:38:42, 1:38:50]: I think it would be advantageous. It's probably already been said, but typically [1:38:50, 1:38:55]: Applicants reach out to the community very early in the process. [1:38:57, 1:39:00]: And I would encourage you to do that. [1:39:01, 1:39:02]: He met the minimum standards. [1:39:04, 1:39:23]: Commissioner. Okay. I I'm not necessarily talking about minimum standards. I'm talking about customer service and community relations and getting along with folk. That kind of thing. Uh it's a lot easier [1:39:26, 1:39:27]: To get support. [1:39:28, 1:39:30]: When you engage people early on. [1:39:32, 1:39:52]: The reality I think right now today is that we're here really for a recombination to solidify it's the rezoning. Yeah, yeah. So um uh while we may can approve the zoning, that does not mean that you can go ahead and start building. Correct. Uh I think that um to rezone [1:39:52, 1:40:02]: own the property to make it one track or or or combine it, it's not gonna have a negative impact on the community. Uh going forward trying to build something. [1:40:02, 1:40:05]: It's going to be a different ball game altogether. [1:40:05, 1:40:09]: And that's why I asked the gentleman had he spoke to the community about it. [1:40:11, 1:40:16]: To let them know exactly what's going on, what kind of impact it's gonna have on their property. One of the things that staff does. [1:40:17, 1:40:20]: is talk about the adjoining property owners and what kind of impact [1:40:21, 1:40:41]: the zoning change or the construction we'll have on their property. One lady spoke today, said that she's already experienced a negative impact of development because uh they are blasting uh the granite, I believe, uh below uh the surface. And as a result of that, uh her foundation was uh adversely affected. So [1:40:41, 1:41:01]: So I think uh well our our task here this evening is simply to approve or deny the recombination, but the recombination will not get you the erection of a building. So uh our actions tonight will not negatively impact your property. Will not negatively imp impact your property. [1:41:01, 1:41:08]: It is the future activities that may impact your property. And I think as counsel as um my colleague has stated, [1:41:08, 1:41:13]: You really need the support of the community and there needs to be a serious study in terms of [1:41:14, 1:41:18]: What kind of impact any construction to go on that property will have on you? [1:41:19, 1:41:28]: And I think that is the point at which you really uh solidify your actions against the uh applicant, developer, owner, whoever. [1:41:31, 1:41:33]: Having said that, can I get a motion? [1:41:35, 1:41:42]: Mr. Chairman, this is Stan Does. I move approval of rezoning case R Z two Zero Two Three Dash Zero T. [1:41:44, 1:41:58]: I have a second. Ms. Harrell. I'll second it. Been moved and seconded. All those in favor, let it be known by the sign of aye. Aye. Aye. Those opposed? Ayes have it. The uh matter is approved for rezoning. [1:41:59, 1:42:06]: But let me say to the audience, this is simply putting two tracts of land together, does not build anything. [1:42:07, 1:42:21]: does not build anything. So our actions here tonight will not adversely affect your property. As uh uh Planning Commission has stated, there's several other stuff they have to go through. This is just a foundational matter here. So [1:42:23, 1:42:24]: Thank you. [1:42:25, 1:42:39]: Uh Mr. Chairman, uh correction if I may please, before the all before the public leave. It's not a rezon uh recombination. It is a just strictly rezoning. They will have to come back and combine them. [1:42:40, 1:42:42]: Okay. At some future point. All right. Thank you. [1:42:57, 1:42:58]: Think item ten is next. [1:43:01, 1:43:21]: Annex case number AX 2023-03 to be located in Council District 5. [1:47:34, 1:47:35]: Staff analysis. [1:47:36, 1:47:56]: Is the subject property contiguous to the existing corporate limits? Yes, the subject is contiguous with the following parcels that are located within the city limits of Stockbridge. [1:48:03, 1:48:06]: They're going to use the one hundred percent method. [1:48:08, 1:48:25]: Is any part of the subject property being proposed for annexation within the within the boundary of another municipal corporation or county? [1:49:36, 1:49:54]: The physical conditions of the site relative to the capability to be developed as requested include the topography, drainage, access, and size and shape of the property. Although the resident units are adjacent to the residents of the Eagle Crest subdivision, the site plan shows that the developer is planning to install a fence around the perimeter of the property. [1:50:14, 1:50:27]: and the impact of the annexation on the city infrastructure, including water and sewage system. A letter from the Herring County Waters Authority dated February twenty eighth, twenty three, stated that the water service along with [1:50:31, 1:50:51]: Along with the sewage treatment and sewer line capacity are available for the subject properties, and the impact of the proposed annexation on the adjacent thoroughfares and pedestrian and vehicular so circulation of traffic volumes, the proposed subdivision will not have any negative impact on adjacent thoroughfares, nor pedestrian and vehicle circulation and traffic volumes. [1:50:53, 1:50:55]: And the staff recommends approval. [1:51:01, 1:51:03]: Yeah, the applicant present. [1:51:03, 1:51:04]: Mm uh. [1:51:10, 1:51:12]: Presentation should be right there. That's your presentation. [1:51:24, 1:51:44]: Good evening, Michelle Battle with Battle Law 3562, Habersham at North Lake, Tucker, Georgia, 30084. Um before I start, um because we've got three applications, I see we did not take them all together. Um we're dealing with the annexation first. Um I do have a presentation and before the clock starts. [1:51:44, 1:51:58]: I I'd like to kind of know whether or not you all would like the whole overview of the project or we're just gonna deal with the annexation because I think there are some issues that I'd like to point out specifically for the annexation before even starting the presentation. [1:51:59, 1:52:01]: Can we hold on that for one second while I get an answer? [1:52:02, 1:52:03]: I want my time sicking. [1:52:05, 1:52:11]: Because you didn't take all I I had anticipated you all taking all three together, but if we're gonna do them separately then I I don't wanna [1:52:12, 1:52:14]: give the same presentation three times. [1:52:15, 1:52:25]: Well, for the benefit of the audience they're not familiar with that, we're probably gonna take'em individually. Okay. All right. So I'm gonna start with the annexation um and and talk about that first. [1:52:26, 1:52:46]: Um the subject property on um three sides are abutted by property that is within um unincorporated Henry County. The property directly across the street is how we are able to annex into the city of Stockbridge. So that property which is zoned RR currently is undeveloped, um kind of a greenway across. [1:52:46, 1:53:06]: Across the street, and we have to cross over to the other side of the interstate before we see many of the residents, at least directly across from the entrance into the project. We certainly are aware of the adjacent residential community, but again, it lies outside. [1:53:06, 1:53:10]: of um the jurisdictional boundaries of Stockbridge. [1:53:10, 1:53:11]: Mm. [1:53:11, 1:53:31]: The current land use designation for the property is mixed use, and in uh Henry County that allows for up to 16 units per acre. What we are requesting is to amend um in a later application the comprehensive plan uh to high density residential, which allows for a similar um [1:53:31, 1:53:51]: Density on site. And so we believe that despite staff indicating that we are inconsistent, we are certainly inconsistent from the perspective of one says mixed use and one says high density. But when you look at the density that is allowed under each designation. [1:53:51, 1:54:11]: they are similar. So um I thought that that is uh important to be pointed out as you all are making a decision with regards to the annexation. Um we believe that the annexation is appropriate. Um again we are in uh an area that is directly across from the city we know that the city is continuing um to grow and we [1:54:11, 1:54:31]: And we are hopeful that this particular project will be invited into the city of Stockbridge. With that said, we'll get started with the other part of our presentation. Avila is a developer of rental homes, and they are here this evening and hopefully. [1:54:31, 1:54:49]: hopes of presenting to you a project that they are extremely excited about bringing to the city of Stockbridge and to the metro Atlanta area. I wanted to start out with a little video presentation that gives you an idea of what it is that they do, and then we'll get into a little bit more detail. [1:54:52, 1:54:54]: Let us hope it plays. [1:54:59, 1:55:05]: This is an overview of a project that they've done in Texas and it gives you a little bit of information here about [1:55:05, 1:55:06]: What it will look like. [1:56:31, 1:56:51]: So that is the presentation in terms of the fly-through. We've seen the location of the current site, so we won't linger there. Staff has made a great presentation of the uses that are surrounding in terms of the zonings. In Henry County, we have OI in this location. We've got RM that's around the perimeter of the site. [1:56:51, 1:57:11]: Again, this RM while single family detached does have a land use designation similar. So multifamily is certainly in this area, and higher densities would be allowed. The site plan that we are presenting to you this evening provides for 136. [1:57:11, 1:57:31]: units. Forty-four of those would be sorry, let me go to the next slide. 44 of those would be one bedroom duplexes. There would be 54 two-bedroom units and 38 three bedroom units. And the density on this project is actually only 9.6 units per acre. What we are taking [1:57:31, 1:57:51]: Typically accustomed to seeing in these types of projects are vertical type apartment complexes. That is not what this is. This is a different type of complex. We know that it is something that is not typical within communities, but it is something that is becoming much more. [1:57:51, 1:58:11]: attractive as people are making a decision that they don't want to actually own, that they want to live in a community in which they can rent but have a home that allows for them to live a particular type of lifestyle. These homes will be single story, detached cottage style homes. They are maintenance-free living, professional [1:58:11, 1:58:27]: on-site management, single family style living with neighborhood amenities, backyards. So if you have a dog, instead of being in an apartment complex and having to worry about coming downstairs and going out with your dog, you can have your dog in your own private yard that is a part of this rental community. [1:58:29, 1:58:49]: Um Avila residents are renters by choice. Many of them have financial means to buy a home, but they choose not to at this point in their lives. Many of them are professional millennials, midlife singles, uh dual-income couples, and empty nesters. 58%, and they're going across the board of all the Avilla um properties that they own and operate, 58% of [1:58:49, 1:59:09]: The individuals who live in there are over the age of 35, and 23% are over the age of 55. The average income in those households tend to be about$132,000. Minor occupants, only 20% of the households even have children. Again, when we look at um [1:59:08, 1:59:23]: the marital status of the people in uh those homes. Um we do have a lot of single individuals, um people who may be widowed or separated, um living in the homes as well, and roughly about forty-three percent of the people are married. [1:59:24, 1:59:37]: Children, again, less than 20% of the folks in these homes have children. Um if they do, it's usually only one child at 11.2%, um two children at six percent and three or more only um two point one percent. [1:59:38, 1:59:58]: Um we believe that this is an opportunity to provide again an alternative to housing. We know that we are in a housing shortage, that there is a need for housing, there are a need for different types of housing, and we believe that this is a housing product that we simply have not seen. Um a lot of times that um the folks who [1:59:58, 2:00:18]: Are moving into these communities again, or people who have made the decision not to live in that single-family detached home any longer that they're paying for and that they have to worry about maintenance and the like. These are perfect for seniors who have resources, but maybe coming out of a larger home, wanting to downsize, don't [2:00:18, 2:00:38]: Want all the extra headaches of home ownership, but want to live not maybe in a designated senior community, but continue to live around others who are of varying ages, but have a space where they have a backyard and you don't have to worry again about all the maintenance. [2:00:38, 2:00:58]: Maintenance and the like. We're here to answer any questions that you may have. I'll take uh I guess we've got three applications to go through, so I'll have plenty of time for rebuttal, but wanted to kind of give you an overview of the project, and we are here to answer any questions. We do have um Sean Rust, who is here with um Next Metro, and he's available as well. [2:00:58, 2:01:05]: to answer any questions that you may have. But we're very excited about this opportunity and thank you for the opportunity to come before you this evening. [2:01:07, 2:01:08]: Thank you, Ms. Battle. [2:01:10, 2:01:13]: Are there any questions from my fellow commissioners? [2:01:15, 2:01:16]: For the applicant. [2:01:17, 2:01:19]: This is just for annexation, right? [2:01:20, 2:01:21]: I'm sorry. [2:01:22, 2:01:25]: This is just for the annexation portion, right? Correct. Yeah. That is correct. [2:01:27, 2:01:28]: Any questions? [2:01:30, 2:01:32]: Thank you, Ms. Barrett. Thank you. [2:01:33, 2:01:38]: I'm gonna open it up now for public comments. [2:01:39, 2:01:46]: Uh and and you've been given instructions earlier on how we do that, what the process is. [2:01:48, 2:01:57]: So at this time I would like to entertain anybody that's in the audience who's in favor of this [2:01:58, 2:01:59]: Project. [2:02:03, 2:02:15]: Hearing none, then I will open it up for anyone who's opposed. I trust that you fill out a form. If you will state your name and address, speaking to the microphone, you have three minutes. [2:02:15, 2:02:30]: Connie Snow, 426 Chase, Marion Way, McDonough, Georgia, 3025 30253. First of all, thank you for letting me speak today. Um, to the lady that just spoke about the development that she's proposing outside of my neighborhood. [2:02:30, 2:02:39]: You speak about a pool and a gazebo. Well, that's great. We won't ever get to use it. But let me ask you a question. What are you gonna do about the multiple times that [2:02:39, 2:02:45]: You have security interferences with people breaking in and breaking stuff. The reason why I bring that up today is. [2:02:46, 2:03:06]: I've lived at my house for 19 years. When I bought my house 19 years ago, it was an idyllic place to raise my child. In the past five years, it has turned nothing more to a crime-filled area that I worry about my kids' safety. In addition, a few years ago we built a racetrack, which increased the foot traffic in my neighbor. [2:03:06, 2:03:09]: In the past two years my car has been stolen from my driveway. [2:03:09, 2:03:29]: Six months ago, I went out to check on a neighbor because I seen an ambulance in front of her house. She's a single lady, lives on her own, been my neighbor for 20 years, really worried about her. Worst mistake I ever made that night. I walked out of my house at two o'clock in the morning to check on a neighbor that I was worried about because I was up late by myself. My family was asleep. [2:03:30, 2:03:33]: I left the door unlocked. As I walked away and walked over to check on my neighbor, [2:03:34, 2:03:47]: There were five or six police cars surrounding her house. She was inside safely, thank God. They had detained some individuals. During that detainment, one broke free, pushed me to the ground, and the police also pushed me to the ground and refused to let me enter my home. [2:03:48, 2:03:54]: During the forty five minutes to an hour that I was waiting to go back home, I was worried if my door was locked, if my children were safe. [2:03:55, 2:04:15]: It took me 30 minutes to get a hold of somebody to lock that door. And in that meantime, I watched as that individual ran up my steps and the police tackled him. That is one of eight to ten incidences of crime I've seen rise in my neighborhood in the past year alone. So don't tell me for a moment that your apartment complex will not bring more crime. In addition. [2:04:15, 2:04:24]: I live in front of the high school and the middle school and probably about a half a mile from the elementary school. Ninety percent of the kids in my neighborhood walk. [2:04:25, 2:04:41]: to the element or walk to the middle school and the high school. They do not ride the bus. There are no sidewalks on that school area. The traffic increase, the crazy drivers. What are you going to do to make sure that my kids do not get hit by one of your tenants in your neighborhood? [2:04:42, 2:04:50]: What are you going to do to make sure that my neighborhood, which is directly behind that, is safe and protected? Excuse me, ma'am. You have to address the chairman, please. [2:04:51, 2:05:11]: At the end of the day, you guys, you want to talk about, she said, uh, most people don't want to own. You're wrong. They do. They can't afford it. They can't afford it because people like you, yourself back here, keep buying the property and make it impossible for them to afford a home of their own. So don't act like they don't want to own. They don't have the availability to. [2:05:10, 2:05:13]: do so due to the corruption and corporate politics. [2:05:15, 2:05:22]: I can keep going on here and here, and I'm can stay here for all your rezoning questions, but I'm not. What I'm going to tell you tonight is I'm strongly opposed to it. [2:05:23, 2:05:28]: I'm strongly opposed to you guys continually deteriorating our neighborhoods. [2:05:28, 2:05:31]: To rezone us into Stockbridge is wrong. [2:05:31, 2:05:33]: Ви вона стай ру. [2:05:33, 2:05:38]: Agriculture. I like coming out in the morning and seeing my deers, the cranes. They're all going away now. [2:05:39, 2:05:46]: When I leave my driveway to go to work, I almost hit five deers every day. Why? Because they have nowhere to go, because you keep cutting it down. [2:05:46, 2:05:54]: I did not move to Henry County to get away from Clayton County and the crime to be right where I'm at 20 years later. [2:05:54, 2:05:59]: And to be in a position where I can't sell my house because there's nowhere else to go. [2:06:00, 2:06:04]: At some point, you guys up here have to make a decision what's best for us. [2:06:04, 2:06:09]: 'Cause you're not. I've listened all night to this meeting where it's been unorganized. [2:06:10, 2:06:12]: Gen does not fill it out correctly. [2:06:13, 2:06:14]: And just not very [2:06:14, 2:06:17]: informative. Most people didn't even get a notice. [2:06:18, 2:06:18]: Do better. [2:06:20, 2:06:23]: And I'd also like a copy of all the minute meetings, please. Thank you. Have a good night. [2:06:25, 2:06:25]: Yeah. [2:06:29, 2:06:30]: Yeah. [2:06:43, 2:07:03]: Um my name's Ann Fields and my address is three two nine Chase Marion Way. I l am the like eighth house down the street from the corner of Holloway on the left side. I moved here a year ago, a couple months, year and a couple months, relocated from Pittsburgh. [2:07:03, 2:07:06]: Pennsylvania for Delta Airlines. [2:07:08, 2:07:11]: During the time that I had been offered my position in [2:07:13, 2:07:20]: My interest rate was two and a quarter percent in Pittsburgh. It took me six months to sell because of the housing market being so different up there than it was down here. [2:07:21, 2:07:22]: I immediately [2:07:22, 2:07:26]: In December, when my household started looking for a new place down here. [2:07:26, 2:07:29]: Retained a real letter out of Noonan and began looking from Noonan to [2:07:30, 2:07:43]: To God knows where towards the ocean at this point because we couldn't get a house. Thirty lost bids later I was able to secure Chase Marion Way. I flew down, my furniture fit. [2:07:43, 2:07:47]: I wasn't going to lose my delta job. I took the house. [2:07:50, 2:07:52]: So we get the letters in the mail. [2:07:53, 2:08:01]: And for the annexing piece of this conversation, I have one question, which is really, I guess, directed towards [2:08:02, 2:08:06]: the people who want to do the development, but maybe you know the answer. [2:08:07, 2:08:12]: If you re-annex the land and you allow that re annexation. [2:08:13, 2:08:21]: Is the land deal a done deal for the existing owner, Miss Lin? Because I created a public post about this whole thing. [2:08:22, 2:08:27]: And Miss Lynn chimed in and she owns the property. It was her father's farm that has been butchered. [2:08:27, 2:08:33]: To make grandfather's farm, to make way for I seventy five and then subsequently Patrick Henry Parkway. [2:08:34, 2:08:39]: So all of that beautiful farmland is now highways and green space. [2:08:41, 2:08:51]: What's left of it, everyone else has passed and the girls need to sell the land. So I respect that and I understand that. We all do. [2:08:52, 2:08:57]: You can't afford to keep farmland and pay those types of property taxes if you don't have the means. [2:08:58, 2:09:07]: So my question is, is the land deal done where Miss Lynn's off the hook and the annexation would take place regardless of who owns the land? [2:09:07, 2:09:12]: Or is this deal contingent upon all three of these being passed? [2:09:13, 2:09:25]: Um, because I'm not for or against Stockbridge taking the property. I saw in the Henry County Master Plan that the future use of that was already stated as city. So to me it sounds like [2:09:26, 2:09:32]: Everyone that runs things has made up their own minds about the annexation, and the annexation's a done deal. [2:09:33, 2:09:38]: But annexation to Stockbridge would also mean an increase on the property taxes of that land. [2:09:39, 2:09:42]: Which would negative negatively impact Miss Lynn. [2:09:42, 2:09:44]: And her family [2:09:44, 2:09:48]: if the property taxes went up any further and this deal didn't go through. [2:09:50, 2:10:06]: So that would be why I'm speaking now. I'm not for or against Stockbridge taking that over. I understand it's part of the big picture, but does your annexation impact Miss Lynn and her tax bill if this deal doesn't go through? [2:10:06, 2:10:13]: Now I would like to be able to come back up and speak on the other two issues. Is that fair? Yeah. Thank you. [2:10:20, 2:10:20]: Yeah. [2:10:21, 2:10:22]: Opposition. [2:10:22, 2:10:26]: You took people up the floor with all opposition. [2:10:30, 2:10:31]: How are you doing this, even? [2:10:31, 2:10:35]: I'm Kenneth Kemple. I live at Fortin Chase Marion Way. [2:10:36, 2:10:56]: McDonald, Georgia. I've lived there for since 1995. And the biggest question I have is the traffic down. Patrick Henry. And then you got Holloway. You got the two schools, and we already got people cutting through there. You cannot get out of the neighborhood during school hours or after school hours. Even police are [2:10:56, 2:11:06]: cannot go through the neighborhood. With the m new traffic added, it's gonna make it more dangerous for fire amlets police. [2:11:10, 2:11:10]: Okay. [2:11:12, 2:11:14]: Oh I thought he was asking you a question. [2:11:16, 2:11:33]: Um trying to think of all the other stuff I was gonna say about it. Oh, and if we have a thunderstorm with Georgia Power is a communication Georgia Power down the road of Patrick Henry. It's not actually Georgia Power there. But a slight breeze will knock out [2:11:35, 2:11:42]: Chase Trail, Chase Marion Way. I mean the power goes off with just the slightest thunderstorm. [2:11:43, 2:11:47]: And they haven't fixed the power problem for ever since I lived there. [2:11:48, 2:11:49]: Yeah, I've been there for twenty years. [2:11:50, 2:11:53]: And that's about all I have to say. And thank you very much. [2:12:08, 2:12:28]: Hi, I'm Tasha Kempel. I live at 410 Chase Marion Way, McDonough, Georgia, three hundred two five three. I do not agree with the index in this for the city of Stockbridge. Um I moved here. That's my husband. Been here for sixteen and a half years. I love my home. I love that it's in Henry County. [2:12:28, 2:12:44]: I used to live in Stockbridge growing up. Um things changed, don't agree with a lot. Um, but there are some pros and there's some cons, of course. Um I was listening to the lady state that um [2:12:44, 2:12:47]: She was interested in that land. [2:12:47, 2:12:50]: To be put in the city of Stockbridge [2:12:51, 2:12:58]: But because of the land across the street is adjacent to City of Stockbridge, why does she like not put her? [2:12:58, 2:13:02]: rental property on that property, why does it have to be next to my neighborhood? [2:13:04, 2:13:07]: My husband retired from the Henry County Sheriff Department. [2:13:08, 2:13:17]: We have had so much crime in this neighborhood, it is unreal. Just like Miss Connie Snow has stated, it is true, I've witnessed it. [2:13:17, 2:13:20]: I'm two doors down from her house. [2:13:21, 2:13:29]: My husband's squat car, sitting in the driveway, had a criminal sit there and spray paint his car in orange spray paint. [2:13:29, 2:13:35]: What happened to that incident, I don't know. He was a juvenile. I have no clue. [2:13:35, 2:13:45]: My m my neighbor that's beside me over there, she had her mailbox sprayed and paint. We've had drive by shootings in this neighborhood. What is gonna protect us? [2:13:45, 2:13:52]: from another community like this to come and like is it gonna like increase in the crime? What's gonna go on? [2:13:52, 2:13:54]: That's my question. Like [2:13:55, 2:13:58]: I don't feel safe in my own neighborhood nowadays. [2:13:58, 2:13:59]: And [2:13:59, 2:14:03]: The fencing, what kind of fencing are they gonna put around this property? [2:14:04, 2:14:11]: Another thing is they have a pr retention pond that they're wanting to put on the back site that would be close to my house. [2:14:11, 2:14:14]: The hospital already has a retention pond. [2:14:14, 2:14:30]: So that's gonna be double the mosquitoes that are gonna attack my neighborhood where um I love going outside. I'm not I'm like I've got my outside like little fire pit, little lounge. I love it. The nature is beautiful. So y'all are gonna tear down these trees. [2:14:31, 2:14:32]: That's not right. [2:14:33, 2:14:42]: But anyways, I do not oppose of it being city of Sotbridge and I respectfully hope that you grant my wish that this does not happen. Thank you. [2:14:56, 2:15:13]: Good evening. My name is Rose Sweeton. I reside at nine six two Chase Trail, McDonough. And I must live in a different area'cause I live in a night I mean, I think I live in a safe area and now I'm kinda nervous. But um all I have to say is [2:15:15, 2:15:35]: I'm not too sure about what everything else except for a place is going right here. And I've lived there since I'm in the second phase. I've been there since nineteen ninety-six. So I call myself one of the oldies, been around there. I've raised my kids there. We played in I've gone in the woods with my kids back there, up and down the woods behind our house. [2:15:35, 2:15:55]: That followed along Patrick Henry Parkway. I wasn't opposed when they put the parkway back there because that gave more room for people to come during traffic time, which is really bad now. But only thing I'm saying is there's just not enough room back there to put more housing. You might see it on paper, and sometimes look good on the paper. [2:15:55, 2:16:10]: on paper. But when you put it into action, it's not so good. So I'm just saying I'm opposed because I just there's just you're just throwing more little ants back there. There's just not enough room to put all those people back there. [2:16:11, 2:16:17]: And I just this is sidebar. I just don't understand. I know growth is growth, but [2:16:17, 2:16:37]: We have seen so many places going up in Mc in McDonough. I mean, so many different apartments all over the place. Has anyone been up and down 75 on that traffic? It's a joke to my friends that live in Calweda County or other places. You know, my sister's like, I'm coming to [2:16:37, 2:16:42]: to see you Friday, but I'm coming, you know, like twelve o'clock to miss all your traffic. [2:16:42, 2:16:43]: But [2:16:43, 2:16:54]: I am opposed to putting the location there. Is it a nice location? Sure. I mean what they're speaking of, what they're wanting to do, yeah it looks really nice. Just not right there. [2:16:55, 2:16:55]: Thank you. [2:17:05, 2:17:07]: So you speaking? [2:17:09, 2:17:10]: Yeah. [2:17:10, 2:17:12]: Are you approaching the podium? Yes, sir. Go ahead. [2:17:14, 2:17:15]: Even everybody. [2:17:15, 2:17:18]: Wait till you get to the wait till you get to the podium, please. [2:17:20, 2:17:22]: Good evening, everybody. I'm I'm Mr. Johnson. [2:17:22, 2:17:29]: Chase Marinway being there roughly. Could you speak into the mic so we can all hear you? The mic is on your left hand side. [2:17:30, 2:17:36]: Twenty seven years and I concur with many things that was said about our concerns about our community. [2:17:38, 2:17:39]: I'm concerned. [2:17:42, 2:17:44]: about the congestion. At the same token [2:17:45, 2:17:47]: There's been many things mentioned about that particular street. [2:17:48, 2:17:51]: And the promises of what was supposed to have been coming over there. [2:17:52, 2:18:00]: Prior to what was built on Jonesboro Road with the Home Depot and all those shops. But because of people and persons in Eagles Landing, [2:18:01, 2:18:01]: Um [2:18:02, 2:18:05]: not making that pass, then all that money [2:18:06, 2:18:08]: Is on Jonesboro that would have been on Patrick Henry. [2:18:09, 2:18:10]: Oh. [2:18:10, 2:18:12]: was not allowed. [2:18:12, 2:18:13]: I do understand. [2:18:15, 2:18:21]: Growth and I do understand money, I do understand increase and looking looking longevity. [2:18:22, 2:18:23]: At the same token [2:18:24, 2:18:25]: Just like yell. [2:18:26, 2:18:27]: Getting close to a hundred, I'm right behind y'all. [2:18:28, 2:18:29]: I'm getting up there too. [2:18:30, 2:18:32]: And trying to think logically. [2:18:32, 2:18:35]: For the young folks behind us, our children and our grandchildren. [2:18:36, 2:18:37]: What would be the right thing? [2:18:39, 2:18:40]: Yes, that [2:18:40, 2:18:41]: Complex. [2:18:42, 2:18:43]: Looks familiar. [2:18:44, 2:18:47]: With some places I have seen in this country of North America. [2:18:47, 2:18:48]: Where they build a new [2:18:49, 2:18:50]: communities like that. [2:18:51, 2:18:55]: And it's good to hear there's more of a ranch style instead of a two, three story type function. [2:18:59, 2:19:02]: My neighbor, you mentioned about a wall. [2:19:02, 2:19:09]: And that that concerns me too. Would it be a wall? Would it be a solid wall? Would it be a fence? Would it would it would it uh cut the noise out? [2:19:10, 2:19:11]: Crime is gonna come. [2:19:13, 2:19:14]: Crime is going to come. [2:19:15, 2:19:19]: I reckon I heard recently about a uh a a bus. [2:19:19, 2:19:21]: We're getting many buses in Henry County. [2:19:22, 2:19:23]: So with that being said. [2:19:23, 2:19:24]: That's more traffic. [2:19:27, 2:19:28]: Where do we go from here? [2:19:28, 2:19:29]: I don't know. [2:19:30, 2:19:32]: How firm the board is on saying yep. [2:19:34, 2:19:35]: It's gonna it's gonna happen. [2:19:35, 2:19:38]: We we green light it and they're gonna start. [2:19:38, 2:19:40]: Tearing the trees down. [2:19:40, 2:19:41]: Come April next year. [2:19:42, 2:19:42]: I don't know. [2:19:44, 2:19:45]: But I stand in agreement with my [2:19:46, 2:19:47]: Fellow homeowners. [2:19:48, 2:19:50]: And being concerned about our community. [2:19:50, 2:19:52]: Just like you will be concerned about [2:19:53, 2:19:54]: Your back door at your home where you live. [2:19:57, 2:19:59]: How can we walk out of here tonight? [2:20:00, 2:20:02]: And a win on this side of [2:20:03, 2:20:03]: Yo counter. [2:20:05, 2:20:16]: And say that we went and stood and we said what needed to be said to convince you all to tell the builders and owners, we're gonna veto this, we're not gonna allow this to happen right now in this season. [2:20:17, 2:20:18]: Yes, I would like for that to happen. [2:20:19, 2:20:20]: Will it happen? [2:20:20, 2:20:21]: We shall soon find out. [2:20:23, 2:20:25]: Please do not allow my words. [2:20:25, 2:20:27]: For being in agreement with my [2:20:29, 2:20:30]: Fellow homeowners. [2:20:31, 2:20:32]: To go in vain. [2:20:33, 2:20:35]: As I stand before you all tonight. [2:20:36, 2:20:36]: Thank you for your time. [2:20:50, 2:20:52]: Hello, I'm Jody Messler. I live at [2:20:52, 2:21:12]: 320 Chase Marion Way. And I am opposed to this development. Um I've been living here for 28 years in the community. I actually was born in Stockbridge. So I've been here for a long time. Um [2:21:12, 2:21:13]: [8473.3, 8493.3]: We when like Kenny said, when the power goes off, we don't have power for at least an hour, sometimes a day. So if if they build this, it's gonna just the if we have a thunderstorm, we're not gonna have power. And I work at home. So that affects my income. Um one of the parents told me. [2:21:33, 2:21:52]: Me that I work with, he works at the hospital, he works in the ER. There's not enough beds in that hospital for to accommodate the people here. The hospitals are backed up for eight hours. If you want emergency care, you can't get it. [2:21:53, 2:21:58]: And the fence that they're talking about building in this community. [2:21:58, 2:21:59]: It's [2:22:00, 2:22:20]: It's gonna allow for dogs to come through and kids to come through and crime to come through. We we're gonna need something there if you could consider if they're gonna build something there to please leave some green space, leave some trees. Uh don't put that many houses that's h high to residential. Just if it's possible, build something else that's [2:22:20, 2:22:32]: At least more rural f and better for our community. Because we're really afraid for our s and we really would like better safety. [2:22:32, 2:22:40]: And rental properties tend to bring our property value down. And I would like to keep our property value up. [2:22:41, 2:22:47]: And of course we've heard about the traffic. My kids had to walk to the schools without sidewalks. [2:22:48, 2:23:01]: This is gonna bring more traffic and more fast people driving down the roads. Nobody the the police are never there stopping these really fast cars in our neighborhood. I walk my dog every day. [2:23:02, 2:23:20]: I have to just uh on no sidewalks and the cars are just really fast and I wish we could do something about that too. This is just gonna add to the the traffic, it's gonna add to pollution. There's gonna be a trash can, a tr a big trash [2:23:22, 2:23:26]: Dumpster right in front of my home. [2:23:27, 2:23:45]: And I'd and the the pond, the retention pond. There's gonna be no more trees and I love trees. I'm always walking and I'd I hate to see those trees cut down. Um these are just a lot of my concerns and I just I'm not aga I'm not for this development. [2:23:47, 2:23:48]: Chairman, time has elapsed. [2:23:57, 2:23:58]: Anyone else? [2:24:06, 2:24:07]: Okay. [2:24:09, 2:24:09]: Hello. [2:24:10, 2:24:12]: My name is Jacqueline Smalley. I live at two eight. [2:24:13, 2:24:14]: What's going on? [2:24:15, 2:24:16]: Okay. [2:24:16, 2:24:31]: Can you hear me now? I'm Jacqueline Smiley. I live at 218 Eagles Crest Court in Madonna, Georgia. This is my first time ever being in in any type of meeting like this, so forgive me if I don't seem so professional. But I would like to say that [2:24:32, 2:24:35]: I am considering I let me put it like this here. [2:24:35, 2:24:47]: I was raised in the projects. I come from the projects and low income housing. But back then we were decent. We didn't kill people. We didn't steal and rob. Today that's what we have. And [2:24:47, 2:24:54]: When she mentioned about um low income housing or people with financial needs. [2:24:54, 2:24:59]: They may have financial needs, but what other needs do they have? They don't wanna work. They may come and want us [2:25:00, 2:25:17]: break to take our cars, steal out with uh break into our homes, hurt our children. Um I'm really afraid of this new development coming into our neighborhood. It's been peaceful there. I've been there since 2001. Never had any problems like we're having now. And [2:25:17, 2:25:23]: I do believe that it's I know I don't believe, I know for sure that it's gonna be worse. [2:25:23, 2:25:24]: Um [2:25:24, 2:25:29]: when they if they bring this into our community. It's not a lot of space there already. [2:25:30, 2:25:37]: You can't even drive out of Hap Holloway Road and Patrick Henry Highway because it's so much traffic there. Are they gonna put up lights? [2:25:37, 2:25:47]: Tipper to allow us to start traveling so we won't be congested and taking us twenty minutes to get out of our own neighborhoods along with that just to go on to Patrionia Highway. [2:25:48, 2:25:50]: And also what about [2:25:51, 2:25:51]: Are we? [2:25:52, 2:25:53]: House. [2:25:53, 2:25:56]: Does a don't apartments decrease our house value? [2:25:56, 2:25:58]: We have put a lot in our houses. [2:26:00, 2:26:02]: Renovated them, upgraded them. [2:26:03, 2:26:04]: None of that would count. [2:26:04, 2:26:06]: If these apartments come. [2:26:07, 2:26:09]: And if it's true, I don't know. [2:26:09, 2:26:14]: But I'm told and when I'm research that apartments do bring down the value of our houses. [2:26:15, 2:26:19]: It wasn't easy for us to buy a house. We struggled. [2:26:21, 2:26:24]: And so we would like to maintain that and keep our neighborhoods safe. [2:26:25, 2:26:27]: Анестила промас де ви хал секері. [2:26:28, 2:26:30]: Were you promised that? [2:26:31, 2:26:36]: We have police zoom zoom uh ride up and down our streets watching us. [2:26:37, 2:26:43]: And this fence, I'm not familiar with this fence. I can't even talk about it. But I'm pretty sure if it's man made, it can be unmade. [2:26:45, 2:26:45]: So [2:26:46, 2:26:47]: That's all I have to say. [2:26:48, 2:26:52]: And I hope you consider what we all have said and our concerns. [2:26:52, 2:26:58]: And also I am a twenty four year retired military veteran, active duty, twenty four year. [2:26:59, 2:27:01]: Iraq, Kuwait. [2:27:02, 2:27:05]: I don't wanna have to have war in my own community. [2:27:06, 2:27:08]: Thank you. I want to thank you for your service. Thank you. [2:27:14, 2:27:15]: Anyone else? [2:27:29, 2:27:49]: Good evening. My name is Nicole Eva. I reside in eleven forty-seven Collins Court, McDonald, Georgia, thirty-twenty-five-three. I am sixteen years old, so I know that my opinion may not be as much of importance as the people around me. Um, but I would like to express my concerns. [2:27:49, 2:28:08]: And really urge everyone here to take in consideration everything that we have said. Um f over these past fifteen years, I have lived with change and I have invited it all, but seeing that [2:28:09, 2:28:24]: The experiences that everyone here has endured and also past makes me think of how worse it can get from the developments that may happen and that can come to pass. Um [2:28:25, 2:28:45]: As said, the hospitals, traffic, everything can worsen. And while I try to look at the pros and the positive things that may come from this project, giving people opportunities to live here, I also am pained to know that there has been people [2:28:45, 2:28:48]: who have been assaulted and also [2:28:48, 2:29:07]: stalks and it pains me to know that the people in my neighborhood are worried for so much stuff. And I just once again I know my opinion may not be as well versed or also not much of [2:29:10, 2:29:28]: put into consideration, I would like for a voice at least of a younger crowd of a younger generation to at least be able to put it forth and let you all come to terms that it doesn't only affect the people of older generations but also of mine as well. [2:29:29, 2:29:30]: Thank you. [2:29:31, 2:29:51]: Thank you. Well let me say your opinion does count. And uh I think uh what everyone has spoken to this evening is about you, but you who are the future of this country, this stockbridge, the city, the municipality, et cetera. So yeah, your opinion does count and I'd love to see more young people come out and uh express themselves [2:29:50, 2:29:57]: in terms of the development and the future of the community. So don't think that your opinion does not count. Thank you. [2:30:02, 2:30:03]: Anyone else? [2:30:11, 2:30:28]: Good evening everybody. My name is Harold Webster and um I'm also on Chase Marion Way. And I was actually looking at that property because I'm a real estate agent and I it it laid off market for a while and I didn't know who purchased it. So then I was curious to know who purchased it and I saw the little sign that was way down the street. [2:30:29, 2:30:30]: You couldn't see it, so [2:30:32, 2:30:45]: I was able to get the take a picture of it and, you know, just express what she was saying that that's not true that I'm not gonna say it's not true, but as a realtor we're having problems with, you know, any kind of inventory. [2:30:45, 2:30:52]: First time buyers are not able to buy because the inventory is not there and we're creating more like [2:30:53, 2:31:11]: renters, right? So there's a a subdivision behind us that they built a whole bunch of houses that's going for like$25,$2,600 a house, you know, but it's it's locking everybody else that's first time buyers out of the market. So I just wanted to put my two cents there. And that that area is so congested [2:31:11, 2:31:12]: Just getting out [2:31:13, 2:31:18]: of that uh off of Holloway on to Patrick Henry is a problem. [2:31:18, 2:31:28]: Um there I can imagine I was thinking about maybe putting one or two houses over there, but a hundred and thirty that's insane. Really, it's insane. I really can't [2:31:28, 2:31:39]: believe that they thought that they could put a hundred and thirty two anything over there'cause it's just a little parcel and then you got the little um reti I don't know what it is, a retirement home or whatever that is over there. But it's just not enough. [2:31:40, 2:31:41]: Space, I mean [2:31:42, 2:31:53]: And the wind blows, the electricity go out, you know, and all those problems that that that we're having, especially with the inventory, which is my concern as an agent, you know. So I just wanted to say that. Thank y'all for your time. [2:32:00, 2:32:01]: Anyone else? [2:32:04, 2:32:11]: That was all opposition. Is anybody uh support any support for it? We didn't get any problems. [2:32:13, 2:32:18]: Uh that closes the public comment. Uh where are we? [2:32:24, 2:32:32]: Yeah, I mean commissions, comments, questions, and ready for a vote? Yeah, I would say no to that. [2:32:32, 2:32:33]: Oh. [2:32:33, 2:32:36]: Yeah, may I have motion? [2:32:42, 2:32:53]: Mr Chairman, before you call for the vote on this annexation case, I just have a comment for uh the applicant. [2:32:55, 2:33:00]: Um, Miss Battle, you've been before this commission uh on numerous occasions and [2:33:02, 2:33:08]: Most of the times I've been able to support what you put forth and there have been a few times that I didn't. [2:33:09, 2:33:19]: But I wanted to commend you because each time that you've come before us you've always been on point with your presentations. [2:33:20, 2:33:24]: And you've always been informative. And I just want to thank you for that. [2:33:25, 2:33:28]: I have two comments though. Um [2:33:30, 2:33:33]: that I would like to put out. Um [2:33:34, 2:33:42]: The annexation is not a prerequisite, uh to the way I understand it, for you to develop this project. [2:33:44, 2:33:55]: Uh, you could very easily do that. Well, I don't know if it would be easy, but I believe you could accomplish your objectives with the property remaining in Henry County. [2:33:59, 2:34:02]: The second comment I have is [2:34:06, 2:34:16]: Stockbridge recently completed an intensive endeavor to do annexation and one of the main reasons that we [2:34:17, 2:34:23]: attempted that and accomplished that was to close up some of the doughnut holes in the city. [2:34:25, 2:34:30]: And it looks to me from my observation that this property [2:34:31, 2:34:40]: Is almost surrounded by unincorporated Henry County properties. So if we annexed it, then we would be [2:34:41, 2:34:57]: doing something contrary to what we just annexed to try to get rid of. The donut holes. So we would be creating another donut hole by annexing this property into the city. That's my opinion. [2:34:58, 2:34:58]: Mr. Chair. [2:35:00, 2:35:14]: Go ahead. I'm done. That's all I wanted to say. I'm our I'm right. On this side. Oh, I'm sorry. Uh I make a motion that we deny the annex fa annexification case uh AX twenty twenty three dash O three. [2:35:16, 2:35:18]: Mr. Stan Doom, so I second that motion. [2:35:19, 2:35:22]: Been moved and seconded. All those in favor, let it be known by the sign of aye. [2:35:23, 2:35:26]: Aye. Those opposed? Nay. [2:35:27, 2:35:28]: We have [2:35:29, 2:35:36]: Three uh nay we would have three three ayes support and one nay. [2:35:37, 2:35:40]: No no, I mean I d I didn't support it. [2:35:40, 2:35:45]: The motion was to deny the annotation. So we have three eyes and one nay. [2:35:46, 2:35:49]: Yeah. Okay. That's what we make sure. Good cow. [2:35:51, 2:35:59]: All those in favor, let it be well, we already said let it be known by sign of eye. Those opposed, motion is carried. The application for annexation is denied. [2:36:00, 2:36:02]: Mr. Chairman, who who [2:36:03, 2:36:05]: Who is [2:36:06, 2:36:09]: Jaden Jaden made the uh initial motion. [2:36:09, 2:36:10]: So tonight. [2:36:10, 2:36:11]: To deny. [2:36:12, 2:36:13]: Thibodeau supported it. [2:36:15, 2:36:18]: Doom was seconded. And Doom was seconded. [2:36:20, 2:36:21]: And who was opposed? [2:36:22, 2:36:23]: Uh [2:36:29, 2:36:30]: You got it? [2:36:31, 2:36:35]: Plash on was nine with nay. [2:36:37, 2:36:38]: They don't stand up. [2:36:39, 2:36:41]: I voted no to the motion. [2:36:47, 2:36:50]: Do you catch that, Miss uh Okay. [2:36:50, 2:36:52]: So on the next on the next two uh [2:36:53, 2:36:55]: Chairman Abdullah all you have to do is read'em into [2:36:57, 2:36:57]: Yeah. [2:36:58, 2:37:00]: And make a motion. We don't have to have a hearing on'em. [2:37:02, 2:37:03]: No problem. [2:37:05, 2:37:25]: That would be item um 11 and 12. Comprehensive plan amendment CP 2023-3 to be located in Council District 5. Consideration of a request for a comprehensive plan amendment to change the future land use designation of three parcels on Davidson Parkway and Walter Way, from low density vertical mixed use to high density residential to allow for. It's right next to I-75 where it joins with I-675. And we have adjacent to the east. [2:42:25, 2:42:32]: East on Walter Way, the existing North Bridge Crossing Subdivision. [2:42:32, 2:42:49]: uh shown here is a small parcel it's one of the smaller parcels also on Walter Way and then the third parcel is this one. This is in the curve of Davidson Parkway and in fact that would be uh the location of the main access to the development. [2:42:50, 2:42:52]: The applicant is D. R. Horton. [2:42:52, 2:42:54]: Um and [2:42:54, 2:42:57]: So it's about seventy eight acres altogether. [2:42:58, 2:43:03]: Most of it is vacant. There is a city owned lift station toward the south end of it. [2:43:03, 2:43:06]: This is in council district two. Um the [2:43:07, 2:43:27]: They've requested um rezoning from C3 to PUD, which we'll discuss more in the next case. Um we have Clayton County um just to the north of this, and then we have vacant land to the south. There is a creek on the property. We have the drive time, uh automobiles. [2:43:27, 2:43:30]: refurbishing business um [2:43:30, 2:43:31]: Down here to the [2:43:32, 2:43:34]: To the south end. Let's see. [2:43:35, 2:43:36]: Here it's right here. [2:43:38, 2:43:40]: Okay, and then [2:43:41, 2:43:42]: Um [2:43:44, 2:44:04]: I'll move down to here. So the applicant has requested to change the future land use designation of these parcels from low density vertical mixed use to high density residential to allow a mixed-use development. There would be 312 total units, of which there would be 184 single-family detached dwellings and 128 towns. [2:44:04, 2:44:13]: Townhomes. So they will need to recombine the three parcels during the land disturbance permit process later on. [2:44:14, 2:44:25]: Uh in doing the research uh on the property, there have been a lot of zoning cases to happen in the past. One was for the existing North Bridge Crossing Development. Um [2:44:25, 2:44:31]: Then uh some others um to the south, immediately to the south was the reefs creek one. [2:44:31, 2:44:34]: DRI that was actually the in the county. [2:44:34, 2:44:54]: Um but now has been annexed into the city. But anyway, uh as part of that development, this uh property was supposed to have been developed into different commercial uses, um uh office uses, big box retail, um hotels and so forth. And then uh there was gonna be [2:44:54, 2:45:12]: be a new roadway called Reeves Creek Parkway to go through it from Davidson Parkway all the way down to uh along the interstate and connecting to well Stevens Road and possibly even creating a new interchange um there at the at the highway at the interstate. [2:45:14, 2:45:20]: About two years ago we had another rezoning case for a proposed industrial development. The council denied that. [2:45:21, 2:45:21]: Um [2:45:22, 2:45:42]: saying it was incompatible with surrounding uses because of uh truck traffic. And now more recently, on July 10th of this year, just two months ago, uh City Council approved um uh major mixed-use residential development on the property again to the south um with thirteen hundred forty seven new houses [2:45:42, 2:45:45]: [9946.4, 9956.7]: Anyway, um so the low density vertical mix mixed use is the current land use designation. It did it does need a comprehensive plan amendment to high density residential. [2:45:57, 2:46:04]: Um that's the subject of this case. We had a study called Livable Centers Initiative LCI study. [2:46:05, 2:46:09]: Um and it showed let me get to the right. [2:46:10, 2:46:22]: Here, uh these circles show different an envision um of employment centers throughout the city and this one where the subject properties would have been I-75 activity center. [2:46:22, 2:46:42]: And it was envisioned to have uh here's uh this is what was envisioned, a big box retail in the red, and uh hotels, office uses, and so forth. And then this this is this is interstate down here, and this is Davidson Parkway. So that was envisioned for this area. Um that was just a study that [2:46:42, 2:46:43]: That was done. [2:46:45, 2:47:05]: So uh there would be a HOA uh established here. Um the site plan. I mentioned the main access. Um let's here's the site plan. So off Davidson Parkway, you would have some townhomes in this area here off Davidson Parkway. That would be the main entrance. [2:47:05, 2:47:12]: And then a secondary access off Walter Way. There would be a few single-family detached homes there, about 15 of them. [2:47:13, 2:47:17]: But most of'em would be all of these in the uh gold color. [2:47:18, 2:47:23]: And then you have the creek um adjacent and they would have uh wetlands and buffers and so forth. [2:47:24, 2:47:26]: Yes, an enlargement of the site plan. [2:47:27, 2:47:28]: Um [2:47:29, 2:47:32]: So anyway, some of this we've discussed we um [2:47:32, 2:47:36]: incompatible with the rezoning zoning, which is why they need to uh rezone [2:47:37, 2:47:37]: Um [2:47:38, 2:47:43]: incompatible with the sort the town homes that they propose would be incompatible with the existing uses. [2:47:44, 2:47:46]: And it would be incompatible with [2:47:47, 2:47:52]: These uh other plans that I mentioned, L CI study and a comprehensive plan which encourages [2:47:52, 2:47:53]: Commercial nodes. [2:47:54, 2:47:55]: uh throughout the city. [2:47:56, 2:48:03]: They feel this would be an ideal location uh for commercial center, incompatible with um these other um [2:48:05, 2:48:07]: past rezonings that I mentioned before. [2:48:08, 2:48:09]: Um [2:48:09, 2:48:13]: And we feel that this would not be um the best use of the property. [2:48:14, 2:48:15]: Um [2:48:15, 2:48:25]: uh again we feel that commercial be due to properties location would would be the best thing and it would be a lost opportunity not to use it um in that way. [2:48:27, 2:48:41]: So we recommend denial of the case. Um if you choose to approve though, approval should be only if rezoning case is also approved. And of course um the three parcels would have to be combined later. [2:48:45, 2:48:48]: Do you have the applicant here? Sorry? Is the applicant here? [2:49:01, 2:49:16]: Do you have your own presentation? I do. Can I unplug it or you can leave it out here? Uh uh, okay, let's see. Let me uh first close this. Can um Okay, there's really only one place to put this in here. Let's see. [2:49:17, 2:49:17]: Checked it. [2:49:18, 2:49:22]: Oh, it's currently in use. Uh you're probably still open. Oh [2:49:22, 2:49:23]: Yeah, yeah. [2:49:25, 2:49:26]: Here, let's just close all of these. [2:49:27, 2:49:29]: I close all of these. [2:49:31, 2:49:33]: Okay, now let's try this again. [2:49:34, 2:49:36]: Okay, here we go. [2:49:40, 2:49:43]: Oh why th this acted funny here. [2:49:45, 2:49:47]: Oh, we got two of these open. [2:49:50, 2:49:51]: Worry, my computer looks worse. [2:49:52, 2:49:55]: No, it does happen in the office too. Keep keep trying this. [2:49:56, 2:50:12]: It's small. I don't think it's gonna fit, it's very small. We can't touch those as part of the computer. [2:50:14, 2:50:15]: Oh [2:50:16, 2:50:19]: This happened before at the office. Close this ridiculous. [2:50:20, 2:50:28]: Huh? How do we do that? Oh every everything. Okay. Now reopen. No. [2:50:31, 2:50:34]: You can't just reopen this? No. [2:50:35, 2:50:36]: So the USB. [2:50:36, 2:50:37]: This one? Yeah. [2:50:41, 2:50:41]: Still. [2:50:43, 2:50:45]: We're trying to remove the [2:50:46, 2:50:46]: Mm-hmm. [2:50:50, 2:50:51]: Mm-hmm. [2:51:23, 2:51:25]: Good evening, Chairman and Commissioners. Thank you so much. [2:51:26, 2:51:32]: Tiffany Hogan on behalf of DR Horton, thirteen seventy one Dogwood Drive, Conyers, Georgia. [2:51:32, 2:51:45]: I am here tonight to present to you on North Bridge Crossing Phase Two. First we are taking up the uh comprehensive land map amendment application. [2:51:47, 2:52:07]: So this is the largest parcel as staff has pointed out to you. I wanted to have this one so that we could see a good location of where the property is located. This is the current North Bridge Phase One development, which is an established community in the city of Stockbridge. [2:52:07, 2:52:27]: Amenity area is actually right here, directly across what would be from what would be one of our access points into phase two. It was always originally contemplated that there would be a phase two of this community, and as things changed with the economy and so forth. [2:52:27, 2:52:40]: uh staff has given you the history of the rezonings once that original developer was not able to complete that phase two. Because of that, actually let me go back one slide to show you. [2:52:44, 2:53:04]: Right here on the front of our property, there are actually already existing homes that were built as a part of phase one of North Bridge Crossing. So these gray boxes that are along the frontage here on Walter Way are existing homes that were built as a part of [2:53:04, 2:53:05]: Of the phase one community. [2:53:07, 2:53:14]: We are seeking a comprehensive plan amendment from low density vertical mixed use to high density residential. [2:53:16, 2:53:36]: This is a map of your current future land use that surrounds the property. The orange is already high density residential, which is again that phase one property. Also, the beige area here is also a residential use. So the uh kind of salmon pink area is our subject property right now. [2:53:36, 2:53:44]: And it wrapped around the residential and was for a vertical low density mixed use. [2:53:46, 2:54:06]: Our current site plan proposes 3.95 units per acre over 79.02 acres. And that is a pretty low density considering there are townhomes on part of the property as well. We have 33.63 acres of open space that we're leaving, or 42.6%. The requirement is 20%. [2:54:06, 2:54:18]: 20% for the rezoning that we are seeking. There are 312 total units. Of those, 128 are townhome lots and 184 single-family detached lots. [2:54:18, 2:54:25]: In your density, um, you currently have low density in the city that's one point two five to two units per acre. [2:54:25, 2:54:45]: Medium density is 2.3, 2 to 3.6 units per acre, and high density, uh, there's a gap, and it starts at 6 to 16 units per acre. So again, keep in mind that we are proposing a plan that shows 3.95 units per acre currently. But because there is that gap there, it bumps us up to how [2:54:45, 2:55:05]: To apply for high density residential. And I did want to point that out because typically, when you're thinking high density, you're thinking more units per acre and a far more dense use, high-intensity use. And for purposes of not muddy muddying the two applications, I will stop there. [2:55:05, 2:55:11]: and then proceed with the zoning portion of my presentation after uh discussion on this one. [2:55:13, 2:55:14]: Thank you. [2:55:43, 2:55:44]: Open for public comment. [2:55:49, 2:55:53]: Those who support, those who oppose. Are you supporting or opposing? [2:55:57, 2:56:10]: I guess I'm a little confused because it's sounds like there's two phases to this. Um a phase one and a phase two, not so much as the building, but I guess one is approved and the other is not. You feel like you have to be a reform, right? How do you approach the podium? [2:56:14, 2:56:16]: But with your name and address. [2:56:16, 2:56:20]: Hi, I'm Lashonda Green and my address is two seven one Addy Lane. I live in North Bridge Crossing. [2:56:22, 2:56:26]: Okay. So my qu I guess question is for the um [2:56:28, 2:56:37]: rezoning, I was under the impression that this meeting today was simply to get approval or denial to rezone from commercial to residential. [2:56:41, 2:56:54]: Um if that's the case, then I am in support of being residential. However, based on the plans that was presented tonight, I'm definitely concerned about how many homes will be placed in this neighborhood in the area. [2:56:57, 2:56:58]: We can tell you the total number. [2:56:58, 2:57:01]: I saw it was like three hundred and thirty two. [2:57:02, 2:57:02]: Thank you. [2:57:03, 2:57:05]: May I approach it. [2:57:12, 2:57:32]: It is three hundred and twelve total units um over seventy-nine acres. And if I think this is the only young lady here, there were two other people that came to our community meeting that were here earlier, but they had to leave because it got so late. Um so if the commissioners would like for me to go ahead and present the entire presentation, I would [2:57:32, 2:57:44]: would do that. I just didn't want to confuse the two applications. So if you would like additional information, since this young lady does have some questions that would be answered in that part, I could go ahead and do that. [2:57:45, 2:57:45]: Okay. [2:58:13, 2:58:16]: Okay, so picking up where we left off. [2:58:34, 2:58:54]: In addition to the comprehensive plan amendment, we are seeking a rezoning from C3 heavy commercial to a planned unit development. As you heard from staff, this property has a uh quite extensive history of rezonings. Most of those rezonings did uh get that rezoned to some sort of commercial. [2:58:54, 2:59:14]: Commercial use. And the last one that was successful with doing that was in the early 2000s, 2010, I believe it was. And there has been no interest since that time in actually developing the project as such. The last rezoning was a proposal to get it to an industrial use, which was [2:59:13, 2:59:25]: denied by this council. So oh uh nearly 15 years now since the last rezoning to a commercial use and there has been no interest in actually developing this project as such. [2:59:26, 2:59:46]: This is some site data information for you. Again, 79.02 acres. We've already covered that. We are leaving 42.6% open space or 33 acres. The requirement for your PUD zoning for open space is 20%. There are no requirements with a PUD for setbacks. [2:59:46, 3:00:06]: But we are offering setbacks of 20 feet, a side setback of five feet, and rear setback of 20 feet. Corner side setback would also be 50 feet. The townhome units that we are proposing for the development would be 24-foot wide townhomes. Those would be two car garage units. The homes [3:00:06, 3:00:26]: That are proposed for the development would be 50-foot lots, and the homes would be two-car garages as well with three to five bedrooms per home. It would also be a mixture of ranch product as well or single-story as well as two-story product within the development. There are an additional nine. [3:00:26, 3:00:46]: 91 guest parking spaces that would be dispersed throughout the community. And I will show you where those are in just one second. We have those dispersed throughout the townhome section as well as the single family detach section to give additional parking for each one of those areas so that no one has to walk too far. We are at [3:00:46, 3:01:06]: Exceeding the parking space requirements for the community. So again, you have an entrance here off of Walter Way, which is pretty much across from where their existing amenity area is. When you come into this entrance, it's a nicely landscaped boulevard entrance. There are a few homes on each side of that to continue the [3:01:05, 3:01:25]: Homes that were already put there in phase one. One of the young ladies that was here earlier actually lives in this home. She did come to our community meeting a couple of weeks ago and express um whether the homes would be too close to her home. So her house was built with a five-foot setback, and what we explained. [3:01:25, 3:01:30]: to her is that we are proposing a twenty foot setback and these homes would be the rear. [3:01:30, 3:01:50]: That's against her side. So approximately 25 foot setback, um, maintaining as much of the tree coverage as we could there. And we also offered to replant some evergreens if some of those trees do have to come out in the development phase, so that there is a evergreen buffer between her home and the next home. And she was [3:01:50, 3:02:10]: Happy with that. This property does have a creek that runs the entirety of the property. It actually runs off of it a bit. And we do suspect that that is one of the reasons that no commercial developer has actually been able to proceed with the project because of the issues with topography that are created as well as the buffers. [3:02:09, 3:02:29]: It just does not make a great commercial site for their development standards once they really get in there and dig into it. Once you come into the community, the main amenity area is located here: swimming pool, playground, pickleball, and tennis courts, as well as some other open area there. There will also be a covered mail kit. [3:02:29, 3:02:49]: kiosk in that section. There will be another male kiosk over here for the townhome units. And some of those guest parking spaces that I was talking about will be located here as well as some that are here. And then there is another set of guest parking spaces that are here as well. So again dispersed throughout the community. In addition to [3:02:49, 3:03:09]: The main amenity area. There's also open space area that will remain here. Again, we cannot touch those stream buffers by federal and state law. There's a nice 25-foot buffer around the entire property, and there are other open space pocket park areas, which is the green that you see, like between the stormwater. [3:03:09, 3:03:15]: water and the parking here, uh as well as some more park uh pocket park areas there as well. [3:03:17, 3:03:26]: North Bridge Crossing Phase Two would provide a mixture of new housing options that are consistent with the original plan for the site to be residential and North Bridge Crossing Phase One. [3:03:26, 3:03:46]: It will help to maintain a family-friendly environment in that area. We are proposing a connection between Reeves Creek mixed-use development that was approved and the community of potential users that would move into North Bridge Phase Two. That is still under some investigation because that topography that I mentioned, there is a [3:03:46, 3:04:03]: very steep drop-off over on the side where it connects to Reeves Creek. That's approximately 50 feet is what they have estimated without actually getting in there, which of course makes that difficult and require some type of bridge and stream crossing. So we're still continuing to investigate that. [3:04:03, 3:04:08]: Uh there has been no interest again in years for the existing site as a commercial development. [3:04:09, 3:04:28]: This development would not add any additional heavy truck traffic for the existing residents. One of the things that we heard at the community meeting was that they can hear those trucks coming through constantly for that drive time that's located in the front of their property, and they're not interested in any additional heavy truck traffic coming through there. [3:04:28, 3:04:44]: And again, the topographic concerns for the commercial development. This is a typical lot layout for the townhouse lots, just to give you an idea from the road with the setbacks, where the units would actually sit on the property and the separation between the units as well. [3:04:44, 3:05:04]: And then we have our typical lot layout here for the detached units. Again, same situation, showing you the road and the right-of-way, the setbacks, and where the units themselves would actually sit. There are five-foot sidewalks proposed for internal both sides of the street. We would also have sidewalks on the frontage of all of the property that we allow. [3:05:04, 3:05:06]: um own along the way. [3:05:06, 3:05:26]: This is the City of Stockbridge zoning map. The brown is the current residential use that is in the area. And again, pointing out that these houses were built in phase one. So they are there and pull over into the site that is currently zoned as a commercial site that we are seeking to rezone as residential to match with. [3:05:26, 3:05:27]: There already. [3:05:29, 3:05:49]: 312 new homes, 128 of those are 24-foot town homes, 184 single-family detached, all two car garages. There would be an option for the end unit of the townhome buildings for one of those to be a four-bedroom unit. All of the others have to be three bedroom units. There will be a mandatory homeowners association. [3:05:49, 3:05:57]: And then we would have the swimming pool, clubhouse, multiple open spaces, the multi use paths, and a playground. [3:05:58, 3:06:18]: This is just some information about some things that DR Horton does to ensure that our projects that are for sale that we're taking care of those folks that are our local hometown heroes. So we offer an incentive program for military, law enforcement, firefighters, healthcare professionals, educators. All they have to do is show their ID and there is an automatic incentive. [3:06:18, 3:06:38]: This is the current incentive is$1,000 towards their closing costs to help offset some of that. DR Horton also, in the current crisis that we are in, has a special program currently to buy down interest rates to 4.99% for our homeowners. So we do all of that stuff to remain dedicated to making homeownership a time. [3:06:38, 3:06:41]: for folks even in a tough market like this. [3:06:41, 3:06:59]: One thing that people also don't know is we actually have a home buyers club, which is basically a free credit improvement home buyer preparedness program. Even if you don't buy a DR Horton home, you can actually participate in this program and it's free of charge. We want to make sure that people are able to purchase homes and stay in those homes for a long time. [3:07:01, 3:07:08]: And with that, I will yield to any questions that anyone has for me. Thank you. [3:07:10, 3:07:10]: Yeah. [3:07:11, 3:07:11]: No more. [3:07:13, 3:07:33]: You have an HOA. Yes, sir. It's mandatory. Yeah. Uh what I've heard since I've been on on this on this board is that uh you end up having rental units in these places. And most homeowners do not want that because not only does it uh decrease [3:07:33, 3:07:46]: decrease the value of their property, but uh they suffer some social consequences of of rentals, you know. And uh what margin have you established for renting? [3:07:47, 3:07:59]: Uh staff did not propose a condition for a rental cap, but we are open to that. Uh typically what's suggested is a ten percent rental cap and we could definitely put that into the governing documents. [3:08:00, 3:08:01]: Okay. [3:08:06, 3:08:10]: All right, we're open for public comment. You wanna approach the podium again? [3:08:15, 3:08:18]: Pardon me? Do I say my name and address again? Yep. [3:08:19, 3:08:26]: Um Lashonda Green. Um address is two seven one at E Lane, Stockbridge, Georgia, three oh two eight one. And I am um [3:08:26, 3:08:28]: Homeowner in North Bridge Crossing. Um [3:08:29, 3:08:38]: So I guess I would say I'm for the rezoning from that commercial'cause I do live on Addy Lane literally across the street from drive drive time. [3:08:38, 3:08:48]: And just last week my son was skateboarding and was hit by a car that was owned by drive time as he was they're driving through there. They drive through there really fast. They're trying to get to work, go to lunch, whatever. [3:08:49, 3:09:09]: Um so that does impact us as homeowners in that neighborhood. Now, as to the proposal for the subdivision, I don't know if that's addressed here or not. I do have a couple of questions. Do I address her or you? To me. Okay. So one question would be: being that you're adding another 322 homes, there's currently already a mandatory HOS. [3:09:09, 3:09:21]: Is that HOA going to be separate and it's going to be now separate amenities or is it going to be conjoined amenities? The other question would be as far as the HOA again with the rental cap. [3:09:21, 3:09:23]: Is this h separate? [3:09:23, 3:09:25]: From the current North Bridge crossing. [3:09:26, 3:09:26]: And [3:09:27, 3:09:38]: Is there no possibilities that we eliminate having so many town homes? Although and let me say I'm a realtor, so I'm a big fan of development and um bringing in home and home ownership. [3:09:38, 3:09:51]: However, I found that a lot of town putting in too many homes in one specific area just creates an enormous amount of traffic. And where we are, there's even with you putting a new um entrance. [3:09:52, 3:09:57]: to come out it's such a short drive to get to that four way stop sign will cause a lot of congestion. [3:10:00, 3:10:02]: Do you address her concerns, please? Yes, sir. [3:10:07, 3:10:14]: So our internal HOA manager has researched and it's our understanding that because the property was rezoned so many times. [3:10:14, 3:10:34]: And at some point during the recession, it was separated from phase one. So the HOAs will be separate because your governing documents now only apply to phase one. So it would be a separate HOA for phase two. We do have a traffic impact study that is in progress. [3:10:34, 3:10:54]: And I'm sorry that it wasn't ready for tonight, but we have been told that we will have the report next week from the traffic engineers. Uh one thing that I did not point out that would help with the traffic is we do have D sell lanes at both of those entrances off of Walter Windows and Davidson Parkway. And of course, any of the other mitigation. [3:10:54, 3:11:11]: recommendations that are contained in that traffic impact study. We would provide a copy of the report to staff as well as to council for review. And we would take those mitigation recommendations into consideration and likely take care of all of them that are in there. [3:11:15, 3:11:16]: That answered? [3:11:16, 3:11:18]: I think so. Okay. Okay. [3:11:22, 3:11:27]: Well that closes the public comment portion of uh meeting and uh [3:11:29, 3:11:31]: Look to the commission for a vote. [3:11:32, 3:11:33]: Motion [3:11:34, 3:11:48]: Mr. Chairman, this is Dave Planchet and I'd like to make a motion we accept staff's recommendation and deny this change to the comprehensive land use plan. Mr. Chair, this is Jaden Williams. I second that motion. [3:11:49, 3:11:56]: It's been moved and seconded. All those in favor, let it be known by the sign of aye. Aye. Aye. Those opposed, ayes have it. The application is denied. [3:11:58, 3:12:03]: Okay, I think that kinda closes off uh this evening. [3:12:03, 3:12:06]: We have project updates. [3:12:06, 3:12:18]: Still have a rezoning. Pardon me? I think she did both of them together. No, we gotta vote separate. Oh, okay. All right. Let's have uh motion on the item fourteen.
