[0:10:31, 0:10:33]: Item number two, mail notice requirement. [0:10:36, 0:10:36]: Staff. [0:10:49, 0:10:57]: Good evening chair, my name is Boyle Linton Channel 1 and I'll be presenting to you the exact amendment for the mail deliverance department. [0:11:03, 0:11:03]: Yeah. [0:11:05, 0:11:25]: So this is the previous um amendment, this is the previous text that we had in section 9.34 of the stock version by development code. And it briefly said that mail notice should have been provided to all adjacent properties. However, um while adjacent properties were [0:11:25, 0:11:43]: aware of the public notice other citizens in surrounding areas were not a made of notice of the uh zoning cases so we had a lot of uh concerns about that so therefore we decided to amend section 9.34 [0:11:45, 0:12:05]: From adjacent property owners to mail notice requirement of 500 feet for public meetings for hearing percerning zoning map, any special use permits, uh amendment of the UDC, major modification of the zoning conditions and bearances, and not only that but the notice. [0:12:05, 0:12:10]: [730.8, 739.2]: Purpose of the request to action. And for any requested amendments on the matter, the notice shall include the current proposal and action. [0:12:29, 0:12:32]: And instead it says mail notice shall be pro provided [0:12:34, 0:12:54]: To all adjacent properties that share a boundary line at least fifteen but not more than thirty calendars days prior to the date of the hearing for all variances, conditional use, modifications, and amendment to the zoning map. And it says that applicants shall mail these notices and provide a community development director approval mailing. [0:12:53, 0:12:56]: A minimum of seven days prior to the scheduled public hearing. [0:13:00, 0:13:11]: And so we did a research, we looked at thirteen different cities um and counties, and the most common denominator that we had was five hundred feet. [0:13:15, 0:13:34]: And based on the research done by the community develop development, staff is recommending the city to extend the mail notice requirement for adjacent property owners only to five hundred meet five five hundred meet. And it was brought before the mayor council work session on March twenty sixth, twenty twenty four with uh approval. [0:13:36, 0:13:37]: And that's it. [0:13:39, 0:13:42]: Thank you, Gordon. Any questions from staff? [0:13:48, 0:13:50]: I have one uh [0:13:53, 0:13:58]: The adjacent property requirement that was in the old [0:14:00, 0:14:07]: Code that's being measured from the property line, that's correct? Yes. And that will continue to be measured from the property line. [0:14:09, 0:14:22]: Going five hundred feet in in every direction. Yes. Okay. That is to increase the n amount of people that get notified when something's going to be. Yeah, to me to be made aware of uh zone cases. Okay. [0:14:23, 0:14:28]: I move approval. I'm sorry. I I need a motion to approve. [0:14:29, 0:14:33]: Mr. Chairman, I make the motion to approve. Is there a second? Second. [0:14:33, 0:14:42]: It's been moved and seconded that we approve the mail notice requirement, the amendment to the unified development code. All in favor, let it be known by the sound of I. [0:14:43, 0:14:45]: Hi. You know polls? [0:14:46, 0:14:48]: Eyes have it. Consider it done. [0:14:49, 0:14:49]: Thank you. [0:14:50, 0:14:51]: Thank you, sir. [0:14:55, 0:15:07]: Item number three, text amendment case, TX twenty twenty-four-o three. Consideration of a text amendment to amend title twelve Unified Development Code. [0:15:07, 0:15:22]: of the stock brid Stockbridge Code of ordinances to provide for various changes to section two point five point two, which contains the regulations for partway mixed use overlay districts. [0:15:24, 0:15:25]: Miss Jackson, please. [0:15:26, 0:15:46]: Greetings again. Thank you so much for reading that into the record. Uh correct. Staff is bringing before you an ordinance to amend Title 12 of the City of Stockbridge Unified Development Code, and we are amending sections two point five point two C and [0:15:46, 0:15:49]: Section two point five point two D. [0:15:52, 0:16:12]: So the purpose of the parkway mitts use overlay is to encourage a balanced mitts of retail, professional, residential, civic, entertainment, and cultural uses. And what we are focusing on again is letters C and D of section 2.5.2. [0:16:12, 0:16:20]: In your packet before you, you should see the current reading of that code, and let's focus on letter C that says permitted uses. [0:16:21, 0:16:36]: So as of now, the code reads any combination of uses permitted in C1, C2, OI, CCR, and MFR are permitted in the overlay district. [0:16:37, 0:16:41]: If you turn your attention to the packet in red that looks like this. [0:16:42, 0:16:45]: Red indicates the changes we are making. [0:16:46, 0:16:49]: And I'm going to read into record what it will read. [0:16:50, 0:17:10]: So C will still be labeled permitted uses, and it will now read any combination of uses permitted in C1, C2, OI, CCR, and MFR are permitted in the parkway MITS use, also known as PMU overlay district. [0:17:10, 0:17:17]: provided that they are not among the prohibited uses in section two point five point two D. [0:17:18, 0:17:19]: Which is listed below. [0:17:20, 0:17:35]: And provided that they meet the stated recomm requirements for the special uses that are listed in section two point five point two C one and section two point five point two C two, which is also below. [0:17:35, 0:17:42]: So I want to call you call your attention back to this sheet that has the prohibited uses as of now. [0:17:42, 0:17:53]: So some of those prohibited uses have been removed from that list and now placed under special uses. And those uses are gasoline stations. [0:17:54, 0:17:56]: Um automobil wash. [0:17:56, 0:18:11]: or you may see it as car washes, um, convenience stores, and other associated uses. So for anyone that's applying to um build a gasoline station, they will now have to go through the special use process. [0:18:12, 0:18:16]: Under B you will see restaurants with drive through. [0:18:16, 0:18:33]: that also was previously listed as a prohibited use, now one will be allowed to do a restaurant with drive-thru through a special use process. And that will include restaurants with drive-thru that have facilities or windows. [0:18:35, 0:18:40]: And other special uses too uh will be determined by the community development director. [0:18:42, 0:18:55]: Now I call your attention to number two, the requirements for special uses. As I mentioned before, you um the applicant would need to go through a special use process to do this. [0:18:55, 0:19:01]: The special use must be located on a property which has a frontage on a [0:19:01, 0:19:13]: Well, it says either either a major collector and I don't think that is in your packet, so I just want to call your attention that it must be a major collector or an arterial road. [0:19:13, 0:19:20]: as is classified by the Georgia Department of Transportation or the Henry County Department of Transportation. [0:19:21, 0:19:33]: B says the property must have a base zoning district which allows such uses. All property designs, this is ceased, all property design standards of the base zoning district must be met. [0:19:33, 0:19:35]: D [0:19:35, 0:19:41]: Any existing non-conforming structure structures may not be enlarged. [0:19:42, 0:19:49]: E. Building facades for both primary and accessory structures must be constructed for [0:19:49, 0:19:51]: А брик он алсайд. [0:19:52, 0:19:53]: F [0:19:53, 0:20:10]: At gasoline stations, an equal number of electric charging stations as gas pumps must be provided on the site, and covered canopies must be provided over gas pumps and electric charging stations. [0:20:11, 0:20:17]: G states an acceptable means of access in internal circulation must be provided. [0:20:17, 0:20:20]: to be determined by the fire marshal. [0:20:22, 0:20:27]: H the required number of parking spaces must be provided. [0:20:28, 0:20:32]: I the required buffers must be provided. [0:20:32, 0:20:39]: And J, the special requirements to be determined by the community development director. [0:20:40, 0:21:00]: So letter D, which is labeled prohibited uses, are now reflecting 19 prohibited uses, whereas before there were 22, and I called your attention that some of those are now required now require special use permits. One that is [0:21:00, 0:21:03]: recently added um [0:21:03, 0:21:15]: that was not a prohibited use prior was number 17, industrial uses, warehouses, and business distribution centers. So that is now a prohibited use. [0:21:18, 0:21:29]: So that covers section two point five point two C and two point five point two D. And if you look at section two, there's just some language stating that um [0:21:29, 0:21:39]: the existing Title twelve section two point five point two C and section two point five point two D are hereby repealed. [0:21:40, 0:21:42]: And that [0:21:42, 0:21:44]: Concludes my presentation. [0:21:53, 0:22:01]: Mr. Chair, I make a motion uh that we approve um idle number three text amendment case tx dash twenty twenty-four dash oh three. [0:22:03, 0:22:04]: And a second, please. [0:22:05, 0:22:05]: What's that? [0:22:06, 0:22:17]: It's been moved and properly seconded that we accept the text amendment case number tx twenty twenty-four-03. [0:22:18, 0:22:20]: All in favor let me know my son of a. [0:22:21, 0:22:22]: Uh [0:22:22, 0:22:23]: Any opposed? [0:22:24, 0:22:25]: Does have it. [0:22:27, 0:22:28]: The amendment is approved. [0:22:29, 0:22:31]: Thank you. Thank you, Ms. Jax. [0:22:37, 0:22:47]: Any comments, additional comments from staff? [0:23:43, 0:23:45]: Uh you got to sign at least two cops for [0:23:46, 0:23:49]: Okay, we're only got one second. [0:23:51, 0:23:55]: I only have one copy. Oh boy's gonna give you an additional copy.
