--- title: Community Zoning Information Meeting date: 2024-11-06 source: 2024-11-06_Community_Zoning_Information_Meeting.wav --- [0:03:38, 0:03:43]: Good evening everyone. I apologize for the delay. [0:03:43, 0:04:03]: I am Kedra Jackson, the chief planner with the Planning and Zoning Department. And I'm going to turn this way to talk to you. A little awkward, but we're going to make it work. Tonight is the community zoning information meeting. This is an informal meeting to discuss upcoming cases for our November 21st. [0:04:03, 0:04:17]: Planning Commission. There is no board involved. There is no voting involved. It's just a casual conversation between the community and the applicants. And if you have any questions for staff, we are here to answer those for you. [0:04:17, 0:04:31]: We do have the applications folders and files to all of the cases you will will hear tonight. So if you want to take a look at those, you may. So with that stated, we'll get started. [0:04:35, 0:04:52]: So uh as I stated before, I'm Keydre Jackson with the Planning and Zoning Division. Tonight here we have Linda Logan, the senior planner, and Gordon Linton, also senior planner. Our director is Ryan Anderson. [0:04:52, 0:05:12]: So let's go over some rules and regulations. As I stated, this is an informal meeting, no board involved. So there's no need to object or, you know, rebuttal um any comments. It's a relaxed meeting. Um we understand that some development does cause emotion or, you know, some passion. [0:05:12, 0:05:32]: And so we ask that you, you know, just remain calm and we can talk to each other with harmony and get our questions answered without, you know, attacking the applicant. The applicant is here to do a development and we're here to, you know, preserve and protect our community. But at the same time, I think we all have a [0:05:32, 0:05:46]: common goal. So we just ask that, you know, everyone that have questions, you can talk to your applicant with, you know, respect and and um definitely we'll get those questions answered for you. [0:05:48, 0:05:53]: So with that stated, we're gonna go over the meeting, how it's set up for tonight. [0:05:59, 0:06:05]: And I'll just read from my phone here. So the first meeting will be [0:06:06, 0:06:17]: the comprehensive plan amendment and that's case CP-202403. Um right now Gordon is passing out the agendas to everyone. [0:06:20, 0:06:29]: So this comprehensive plan land use designation amendment is for the case on Brush Creek Court. [0:06:30, 0:06:43]: What they're doing is changing the designation from its current future land use designation to a low density, midst-use, medium density residential to allow for a townhome development. [0:06:46, 0:06:49]: And Gordon, I need one too. I need one. [0:06:53, 0:06:58]: Also with this case is a rezoning. The rezoning [0:07:00, 0:07:03]: And I apologize, I cannot read from here. [0:07:04, 0:07:05]: Thank you. [0:07:07, 0:07:10]: The rezoning is a consideration. [0:07:17, 0:07:25]: To rezone the property from SR suburban residential to OI. This is not correct. [0:07:32, 0:07:33]: I don't know [0:07:36, 0:07:50]: That's not the okay yeah. Let me just read from here. So it's a consideration of a rezoning to rezone parcel S07-010-060. [0:07:51, 0:08:10]: On the east side of Brush Creek Court, from C2, which is general commercial, to MFR, multi- multiple family residential, to allow for a townhome development. The applicant is Pivotal Enterprise LLC in care of Battle Law, PC. [0:08:11, 0:08:18]: The property is located on landlot 59, District 12, and it contains 2.28 acres. [0:08:20, 0:08:40]: The next case we will hear tonight is a comprehensive land plan amendment, CP-2024-07. This comprehensive land use change will um change the designation of four parcels on the south side of Davis Road as [0:08:40, 0:08:55]: identified below in your agendas if you have the full agenda. The property is for the purpose of allowing a self-storage warehouse development. The property owner is [0:08:57, 0:09:05]: B1 Home Improvement LLC, and the agents are Robert Nespit and Rogers Gaudier. [0:09:05, 0:09:13]: The property is located in Landlot 71, District 12, and it contains approximately 6.895 acres. [0:09:14, 0:09:21]: And in your agenda there are the parcel information as well as the address and parcel number. [0:09:23, 0:09:43]: The next case we will hear is a rezoning case, RZ-2024-08. And this also accompany the comprehensive land use language I just read to you. Here, along with the land use change, they're asking to rezone the property from SR. [0:09:43, 0:09:44]: Or [0:09:45, 0:09:52]: an OI to C3 Heavy Commercial to allow for the self-storage warehouse development. [0:09:52, 0:09:59]: the applicant information is still the same and it relates to the four parcels listed in your agenda. [0:10:02, 0:10:06]: The next case, and this is case number five. [0:10:08, 0:10:13]: It's a rezoning RZ dash twenty twenty-four dash zero nine. [0:10:14, 0:10:16]: This is located in district two. [0:10:16, 0:10:30]: The applicant here is seating seeking to rezone parcel 013-0101-8000 on the east side of Black Hall Road. [0:10:30, 0:10:33]: It's south of Walt Stevens Road. [0:10:33, 0:10:37]: It is currently zone SR, which is suburban residential. [0:10:38, 0:10:44]: And the applicant is seeking to rezone the property to RR, which is rural residential. [0:10:46, 0:11:06]: to allow for a subdivided lot. Property owners, there are several property owners. The applicant is AP Property Solutions, LLC. The agent is Sibley Miller Surveying and Planning Incorporated. This property is located in landlot 24. [0:11:06, 0:11:12]: District 12 and it contains approximately 4.849 acres. [0:11:16, 0:11:31]: The next two cases listed on the agenda will not be heard tonight. Um the applicant is seeking some amendments to the site plan so we will um entertain the zoning um [0:11:32, 0:11:39]: agenda for that at the next meeting and we will uh rezon I'm sorry, we will um [0:11:41, 0:11:47]: l relisted as a legal ad with the correct information. So we will announce that when that comes up. [0:11:48, 0:11:50]: So with that stated [0:11:52, 0:12:09]: We're going to get into the zoning process. So for those of you that do not understand the zoning process, I'm just going to give you a snippet or how it works. So normally when a developer wants to do a development in the city, they set up a [0:12:09, 0:12:24]: pre-application meeting with staff and in that meeting they're presenting their project to us. Staff is providing comments and um in relation to the zoning, future land use designations. [0:12:24, 0:12:44]: You know, we're talking about design layout, et cetera. Um, if there are conditions from a previous rezoning, we're providing that information to you as well. And those previous conditions could affect the development. Um, if one is wanting to make some changes to the previous approved conditions, you may have to go. [0:12:44, 0:12:49]: go for zoning modification. So with that stated, once those [0:12:49, 0:13:05]: um issues are addressed and you're ready to submit, we have application deadlines and one would need to submit their application deadline to get on the agenda. So here, all of you are here met that application deadline. [0:13:05, 0:13:25]: You satisfy the application process, and that places you here tonight for CZIM. After this meeting, then you move to planning commission meeting, and there you have five members that will make a recommendation to the city council on whether they want to approve, deny, or derive. [0:13:25, 0:13:29]: [810.0, 830.0]: Decision by that board is not a final decision. The final decision will come from mayor and council. At the mayor and council, they will decide if they want to continue your case, deny the case, or approve it. And they also have the autonomy to add conditions, more conditions, if staff place conditions. [0:13:50, 0:14:00]: on it, they can add more conditions to your case or amend our conditions. So this is just a chart to show the zoning process of how that works. [0:14:02, 0:14:04]: Does anyone have any questions that's power? [0:14:05, 0:14:22]: This is just an informational meeting and if I want to know more about what's going on from a from a residential or resident standpoint, would it be better when we go to the next meeting? Or or is this just more [0:14:24, 0:14:30]: So to sh be sure I understand your your concern has nothing to do with the cases tonight. [0:14:30, 0:14:35]: Only just running information on one process. Uh not come back with a [0:14:36, 0:14:46]: Okay. Um you can speak to either Linda or Gordon, they can assist you. Or if you see your applicant, you can speak to Hemahart directly. [0:14:47, 0:14:58]: Sure. You can get your information tonight or if you want to go to the next meeting, of course, we would love for you to come to the meetings to further ask questions. It's a public hearing. [0:15:02, 0:15:13]: Yes, so after I'm done with this slide, I'm gonna open it up to the applicant so they can now present their case to you. Okay. [0:15:15, 0:15:21]: Here is the schedule of our community zoning information meetings, the [0:15:21, 0:15:40]: Tonight is November 6th, of course. So after this meeting will be December 4th and then January 2nd, 2025. Um and then we'll will um present the new calendar for 2025 and it will have the schedule for both planning commission as well as um city council. [0:15:43, 0:15:51]: So with that stated, we can go ahead and get into the first case. So again, the first case is battle law. [0:15:51, 0:16:01]: for Brush Creek Court. Um they will be presenting the comprehensive plan rezoning and zoning modification. I'll open the floor to you. [0:16:17, 0:16:19]: I sent a PowerPoint over. [0:16:21, 0:16:23]: I said I sent a PowerPoint over. [0:16:25, 0:16:27]: I sent it to you all this afternoon. [0:16:31, 0:16:33]: Thank you. [0:16:38, 0:16:39]: Right. [0:16:40, 0:16:42]: Oh there. [0:16:42, 0:16:45]: Well you just added up. I did. Okay. Okay to see. [0:16:49, 0:16:50]: Okay. [0:17:03, 0:17:05]: How about that? [0:17:06, 0:17:20]: All right, my name is Michelle Battle. I'm here with Battle Law. Um, we are gonna talk about the Brush Creek Court um project. Um before I start, is there anybody here specifically for that project that has any specific questions regarding it? [0:17:21, 0:17:41]: No? Well okay, we'll just move on through. Um so the property um that we're talking about here is located off of Brush Creek Um Court, um right near the intersection of um uh North Henry Boulevard, um where the Quick Trip and the Waffle House are located as you move up uh [0:17:41, 0:17:45]: Um into the site. We are off on the right hand side. [0:17:48, 0:18:08]: Property currently has a zoning designation for commercial development as well as a land use designation for low density mixed use. We are asking to amend the comp plan in order to allow for residential development up to eight units per. [0:18:08, 0:18:23]: per acre. So we are seeking a modification to medium density residential, which is consistent with the property that lies behind, that also has a land use designation of medium density residential. [0:18:26, 0:18:46]: Um Brush Creek Commons was actually approved. I think back in like two thousand and four, two thousand and five, at that time, there was a development agreement that was put into place that governs along with the zoning for the property for the development of a forty-one year. [0:18:46, 0:19:06]: Unit townhome community. That community has no access to Shields Road. It has a lot of terrain and environmentally sensitive issues around the perimeter of the site, but it also included amenity areas that are located along. [0:19:06, 0:19:26]: uh the corridor of Brush Creek Commons. Um the applicant is seeking to rezone this 2.28 acre oops, sorry, moving too fast. In order to allow it to be phase two of the overall project, which is what you see. [0:19:26, 0:19:46]: The above, so you can see how the two will interplay. These 41 units will be rear entry units based on how it was approved back in 2004, and then with some modifications in 2022. This portion being phase two. [0:19:46, 0:20:06]: Two, we are seeking to have uh 20 units on that phase. The overall density when combined will be at 3.39 units per acre. It's a process that we have to go through between the comp plan change and then also seeking the rezoning to the MFR. [0:20:06, 0:20:26]: our zoning district from C2 to allow for phase two to be added into the overall Brush Creek Commons community. They will be sharing the amenity areas that are located throughout the site. As you can see going into Brush Creek, there [0:20:26, 0:20:46]: There are amenities and this picture is so small I cannot tell you what it says right there. Um but um there's gazebos and other amenities along this portion of the project. I don't think you can see my cursor moving there. Um and then we're on again the opposite side. Um there's [0:20:46, 0:21:06]: Some guest parking. There are 20 units with front entry, these being front entry units. These are the elevations that are proposed. They will have two car garages with two car parking pad in the front of each unit. We think this is very stylish. [0:21:06, 0:21:23]: Um it's a three story product and we believe that that is uh in alignment with the direction that um the city has been going in terms of providing a variety of townhome product um within the community. And that's all I have for this evening. [0:21:26, 0:21:28]: Did anybody have any questions? [0:21:30, 0:21:31]: Okay. Well thank you. [0:21:49, 0:22:03]: Thank you, Ms. Battle. Um at this time, if you have any questions for her, you're more than welcome to speak to her. Um if you would like to look at the applications, you're more than welcome to see staff to review those documents. [0:22:16, 0:22:20]: So with that stated, we'll go to the next case. [0:22:23, 0:22:26]: And the next case before us will be [0:22:29, 0:22:48]: A comprehensive plan amendment as well as a rezoning for six four nine, six five seven, and six eight one Davis Road and for parcel number S05-08006000 on Davis Road. [0:26:38, 0:26:58]: For your patience tonight. The last case we will hear tonight is a rezoning for the consideration of a subdivision lot. This is parcel number zero zero one three-zero one zero one eight zero zero zero. [0:26:58, 0:27:06]: On the east side of Black Hall Road, you may come up to present your case. Thank you. [0:27:45, 0:27:46]: Oh. [0:32:22, 0:32:25]: Thank you. [0:32:26, 0:32:32]: Um they would need to meet Henry County Water Authority's um regulations. [0:32:34, 0:32:34]: I'm sorry. [0:32:36, 0:32:45]: Right, n not right now. So in order to get water service there, they will have to install their own meters and pay water impact fees. [0:32:49, 0:32:56]: So no, actually what they're gonna do is rezone the property to R R Rule Residential and then do septic. [0:32:58, 0:32:59]: Right. [0:32:59, 0:33:03]: Right. So that's that's the reasoning for the R R. [0:33:22, 0:33:23]: Yeah, [0:34:36, 0:34:41]: Planning staff, thank you for coming out tonight. Do does anyone else have any other questions? [0:34:43, 0:34:44]: Okay. [0:34:45, 0:35:05]: Well, great. If you have questions later on after tonight, you're more than welcome to contact staff to ask of any questions dealing with cases on this agenda. This case will go before the Planning Commission on November 21st. And that meeting starts at 6:30 p.m. here in the city council chamber. [0:35:05, 0:35:25]: Chambers. And then after that meeting, the cases will move to mayor and city council on December 9th at 6 p.m. Also in the City Council Chambers. We thank you for attending tonight and we look forward to you coming to our meetings and of course getting more involved in our [0:35:25, 0:35:28]: community discussions. Thank you. Have a great night. [0:35:36, 0:35:36]: Okay.
