--- title: Work Session Meeting date: 2024-11-19 source: 2024-11-19_Work_Session_Meeting.wav --- [0:02:32, 0:02:41]: All right, ladies and gentlemen, we're gonna get the meeting started and do have a quorum here tonight. So I'd like to call our council work session uh Tuesday [0:02:41, 0:02:43]: November nineteenth to order. [0:02:43, 0:02:44]: And actually I [0:02:45, 0:03:05]: Thank you. If you bow your heads, as we conduct this last meeting before Thanksgiving, today is the perfect opportunity to say how much we have so much to be thankful for. We thank God for having his covering hand over the city of Stockbridge and for the abundance of joy and overflow that he has. [0:03:05, 0:03:07]: Provided for the city. [0:03:07, 0:03:10]: He's provided safety and security for the city. [0:03:10, 0:03:13]: He's provided guides and guidance and wisdom. [0:03:13, 0:03:33]: And he's provided so much joy in the year of 2024 that we have so much to be thankful for. But that's just the beginning. That's so much more, and so many more blessings in stow as we move forward with so much to be thankful for. Let's be thankful for our families. Let's be thankful for every citizen. [0:03:33, 0:03:46]: And in our community and the surrounding communities and pray for their abundance and overflow and excess in their lives, so that we can make sure that no one is left behind as we move the community forward. Amen. [0:03:47, 0:04:03]: Amen. All right. Pledge allegiance. Pledge allegiance to the flag of the United States of America and to the Republic of which it stands, one nation, under God, and the liberty and justice for all. Madam Clerk, rule calls. [0:04:04, 0:04:18]: Good evening everyone. Mayor Ford. Present. Mayor Pro Temberry. Let the record reflect Mayor Pro Temberry is not in attendance. Councilmember Alexander. Present. Council Member Barber. Present. Councilmember Gantt. [0:04:19, 0:04:32]: Let the record reflect Councilmember Gantt is not in attendance. Councilmember Thomas. Mayor Ford, you have a call. Thank you, Madam Clerk. I appreciate that. Councilman Alexander, sir. I need a amendment to the to the agenda for this evening, please. [0:04:32, 0:04:43]: Yes, sir, Mayor, I'd like the motion to amend the agenda to defer item number four, Text Amendment case TX two zero two four four four four four four zero six to be heard at a later date to be determined. [0:04:44, 0:04:45]: Is there a second event motion? [0:04:47, 0:04:51]: Is there a second to the motion? Oh Mr. Mr. Thomas Second. All I'm fair, please indicate. [0:04:53, 0:04:54]: Okay. [0:04:56, 0:05:01]: Oh yes ma'am. I'll abstain. I don't know why it's being deferred. [0:05:01, 0:05:07]: It's being deferred but based on legal advice is my understanding. Um Mr. um [0:05:08, 0:05:11]: Ms. Gardner, you want to address that, please, further? [0:05:17, 0:05:25]: Yes, the legal department um has some comments on it before we bring it to you, we'd rather address some of the comments we got from the legal department. I'm sorry. [0:05:25, 0:05:43]: Sorry. My apologies. Um, legal counsel had some comments and so we want to review and address those comments before we bring it before you. So that's why we're asking for it to to for continuance so that we could address those new comments we got and bring it back. Okay. Thank you. [0:05:44, 0:05:54]: Now m what uh Mr. Alexander you you made a motion. Mr. Tom yes sir. Before you uh complete the motion, I just had a question. Um [0:05:55, 0:06:05]: Ms. Garner? Will that information come to the council based on your research or statement? Will it come before the council before the meeting? [0:06:05, 0:06:12]: So we have an opportunity to see and understand what you just indicated that you needed to do. [0:06:13, 0:06:14]: As to the reason why it's being [0:06:15, 0:06:15]: Defer. [0:06:16, 0:06:18]: So you want to see legal comments on [0:06:18, 0:06:26]: Well, I mean in in order for us to be able to vote on it when it do come back and I think um and I won't speak for uh Councilwoman Barber, but [0:06:26, 0:06:28]: There's a reason why. [0:06:28, 0:06:31]: And I just want to know what would it impact? [0:06:31, 0:06:41]: our decision based on that and if it if it does not then I do understand. Okay. So uh it does not impact our decision based on the delay. Right. [0:06:41, 0:06:52]: So specific specifically what those legal commons legals have, I don't know specifics. So until we sit down with them, they just said that hey, we see some issues we wanna address with you guys on it. [0:06:52, 0:06:53]: And so [0:06:54, 0:06:59]: We'll highlight whatever those areas are so or have them write a memo so you'll know what those issues were. [0:07:00, 0:07:00]: Thank you. [0:07:00, 0:07:08]: Fair. Okay. Thank you, sir. All right. So Mr. Alexander, you made a motion. Mr. Thomas, you second that motion. Right. Okay. All in favor, please indicate. [0:07:10, 0:07:10]: Mm. [0:07:14, 0:07:14]: I'm sorry, ma'am. [0:07:16, 0:07:17]: No, it's the same motion. [0:07:19, 0:07:33]: The motion it was m motion was made and seconded and uh Miss Barber had some questions about it, so I brought Mrs. Garden up to explain the question. So I just reiterate the motion was made and seconded. Okay. Okay, all in favor of the motion, please indicate. This will be a new motion. Why would it be a new motion? [0:07:34, 0:07:36]: Because I abstain on the first motion. [0:07:37, 0:07:37]: Well [0:07:40, 0:07:40]: All right. [0:07:43, 0:07:47]: Um any legal advice on that at all? Does it make a difference? [0:07:49, 0:07:51]: Mayor Ford. Yes, sir. [0:07:53, 0:08:13]: Go ahead. I'll make a new motion to remove it from the agenda. Go right here, please. Uh I'll make a motion to amend the agenda to defer item number four, text amendment case TX two zero two four-zero six to be heard at a later date once the information from legal is deemed. [0:08:13, 0:08:14]: Mm. [0:08:15, 0:08:16]: Gives you a second emotion. [0:08:16, 0:08:19]: I second. Okay, Mr. Thomas, second that motion. [0:08:19, 0:08:20]: Is there any further discussion? [0:08:21, 0:08:22]: All in favor of motion, please indicate. [0:08:23, 0:08:29]: It's a unanimous decision. Thank you very much. Okay. Now I need a motion to adopt the rest of the agenda, please. So move. Is there a second? [0:08:29, 0:08:31]: I take it. Mr. Cant Sexton, all favor please indicate. [0:08:33, 0:08:47]: Nam is it an ambush? Okay. All right. So please review the minutes, uh review the council meeting minutes for November twelfth. We'll be able to uh approve those minutes at our next uh meeting. And Madam Proke, do we have any public comments at all? [0:08:49, 0:09:09]: All right, so unfinished business. Council consideration approved proposed right-of-way abandonment of um 10,040 square foot or two point uh excuse me.23 acre right-of-way rendement of old Atlanta Road between Clifford Court and North Henry Boulevard. And uh Mr. Gardner, are you presenting? [0:09:09, 0:09:10]: [554.0, 557.2]: Oh Miss Aaron's present. All right, Miss Aaron. [0:09:33, 0:09:33]: Ivni. [0:09:35, 0:09:36]: Good evening, everybody. Evening. [0:09:42, 0:09:43]: Didn't it? [0:09:58, 0:10:09]: Yes, miss uh the the client, the participant is requesting that the city abandon this portion of a right-of-way of Davis Road. [0:10:10, 0:10:12]: Due to the uh I mean say [0:10:13, 0:10:26]: Old Atlanta Road due to G Dot reconfiguring the intersection of Davis Road and North Henry Boulevard. So this would leave this road just abandoned and also it would bisect this property. [0:10:26, 0:10:34]: Uh you'll have it running down the middle of the property, you have a an abandoned road bed that will no longer be used and no longer be traveled by. [0:10:35, 0:10:43]: And I think that they're trying to incorporate it into the property so that it's a whole parcel instead of it being bisected by an abandoned roadway. [0:10:50, 0:10:53]: So let me move to the next slide. Next slide. [0:10:54, 0:10:56]: So this is let me [0:11:01, 0:11:17]: If you can see that, this is the site plan where it shows where the the roadway will be abandoned and incorporated into the property. And then I think they're proposing a project there as well once the property is made whole. [0:11:23, 0:11:38]: And so the total site is four point oh one acres. The building footprint is twenty nine thousand three hundred and fifty square feet. They're proposing to build a storage facility there with twenty one parking spaces and one eighty eight parking space. [0:11:41, 0:12:01]: So the zone in track one and three are zone C three, track two is zone C one, PMU, partway misuse, overlay district. Easements, there are various uh easements for sewer line construction and maintenance, but it will not impact the city or the Henry County Water Authority ability to access their UTC. [0:12:01, 0:12:03]: [727.6, 743.5]: So this road improvement that GDOT is doing on Highway 42 and at that intersection includes new sidewalks, a deceleration lane, and curb and gutter. And also on this project you'll have two stormwater management facility ponds to support this facility. [0:12:26, 0:12:28]: Are there any questions? [0:12:29, 0:12:32]: I do. Go ahead, sir. Ryan, come to the podium. [0:12:39, 0:12:59]: We talked about this and I think my congestion conjecture with this is that these two parcels being combined into one usurps the highway overlay corridor plan, which pr prohibits storage facilities from being located along North Henry Boulevard. When you combine them into one [0:12:59, 0:13:19]: One, the effect when all of this is done is that there will be a storage facility with clear view from North Henry Boulevard and frontage. Now the staff made the decision to uh move this forward without bringing it to council and then made the decision to uh do uh to zone this. [0:13:19, 0:13:22]: [806.4, 826.4]: Because the one parcel that we're talking about that you're gonna use for the parking lot, that parking lot parcel is is in is in the highway corridor. The highway corridor prohibits storage facilities from being located along North Henry Boulevard. When you combine you're allowing them to use this as a parking lot for [0:13:46, 0:13:47]: Well the storage facility. [0:13:48, 0:14:02]: When in effect that's what is going on here. You will be they will be able to use this frontage uh as the parking lot using that right away abandonment that we are proposed that you are proposing to move through this area. [0:14:03, 0:14:15]: So the staff did not zone this property. This property has been zoned C three prior to any of us being here. I mean the one right at the interstate, right at North Henry Boulevard, is in the highway corridor. [0:14:15, 0:14:23]: So no, I'm I'm trying to correct the record because it was said that the staff zoned the property without bringing it forward to council and that is not [0:14:23, 0:14:26]: A correct statement. Staff did not zone this property. [0:14:26, 0:14:35]: This property has been, it's a legacy zoning, has been zoned like most properties along that corridor, either C1, C2, C three, [0:14:35, 0:14:38]: high industrial or low industrial along that corridor. [0:14:39, 0:14:39]: Right. [0:14:39, 0:14:47]: Um so the city the staff did not arbitrarily zone this property. The property has already been zoned, I think as the staff it showed. [0:14:48, 0:14:53]: Part of this property, the old roadbed, the dear oxing to abandon, is the area right through here. [0:14:53, 0:14:56]: If you can see it on your on your screens. [0:14:56, 0:15:04]: Right, the dissects their property. So there's a piece of their property that's here. Mr. Gardner. Can you see it on your screen in there? [0:15:04, 0:15:08]: Can you see my cursor? It's not showing up on the big map. Can you see it on here? No. [0:15:10, 0:15:15]: Okay. So if you if you're looking at the plan, you will see a dark line [0:15:15, 0:15:20]: With little two arrows next to it, where their main drive is coming off of Old Atlanta Road. [0:15:21, 0:15:26]: That all a lana road goes through their property where you see those dark lines. [0:15:26, 0:15:29]: And goes into North Henry Boulevard. [0:15:29, 0:15:33]: So there's a piece of their property right here that's [0:15:33, 0:15:39]: Um, on one side of the Old Orlanta Road and then there's the major portion of it that's actually on [0:15:40, 0:15:41]: Um [0:15:41, 0:16:00]: off of the other side of Old Order Road that's gonna be abandoned. So it dissects their property right on the edge on the northern, on the eastern, western side of the property line, right here. Right. Um I'm not seeing that. Is there a way that you can show some type of arrow or something pointer so people understand what you're talking about? [0:16:01, 0:16:05]: No, I'm using the mouse, it doesn't show it. Um [0:16:05, 0:16:08]: So the best way to gauge it [0:16:08, 0:16:12]: Um Jesus. Without y'all being able to see, we don't have a pointer on here. [0:16:13, 0:16:16]: Hold on, let me do this. Let's take it out of this mode. [0:16:19, 0:16:27]: Can you see my mouse now? We can see the arrow now. Okay. So the road is being abandoned right next to Walmart, which is Davis Road. No, no, sir. No, sir. No, sir. [0:16:29, 0:16:33]: So the abandonment is this piece of property right here. [0:16:34, 0:16:35]: Right through here. [0:16:36, 0:16:39]: That's the old roadway right there where there are driveways coming out of. [0:16:40, 0:16:50]: GDOT is reconfiguring Old Atlanta Road so it doesn't come in at that funky angle. It comes in more at a ninety-degree angle, which is your typical road section. So that's where it's coming through here. [0:16:51, 0:16:55]: So their property technically does not actually front on [0:16:55, 0:17:02]: Well, the project doesn't front on or do have a driveway off of Eastern Lana Road, it has a driveway off of Old Atlanta Road. [0:17:03, 0:17:03]: Right. [0:17:04, 0:17:13]: So there's parcel number three that's a remnant piece of their property. When Old Atlanta Road was built, yeah well however long ago that was, it dissected their their property. [0:17:13, 0:17:26]: So the majority of the property is over here. There's another piece here just becoming because Davis Road is actually also being realigned in this process. So Davis Road currently goes in that configuration. [0:17:27, 0:17:28]: Red comes in straight down at angle. [0:17:29, 0:17:31]: The new alignment brings it and curves it. [0:17:31, 0:17:32]: And gives it two. [0:17:32, 0:17:35]: Where you can go north or you can go straight across. [0:17:35, 0:17:44]: So that's the new alignment for the road, for Davis Road. So there are two roads being d being relocated or realigned on this as it relates to this parcel. [0:17:45, 0:17:48]: So they're reflecting a driveway off of Ola Lana Road. [0:17:48, 0:17:54]: and a driveway off of Davis Road directly across from the access into the Walmart shopping centre. [0:17:55, 0:17:56]: Now as it relates to [0:17:57, 0:18:03]: The overlay district, the overlay district only actually affects tract number two. [0:18:04, 0:18:07]: from the overlay district map. And correct me if I'm wrong. [0:18:08, 0:18:09]: It only affects track number two. [0:18:10, 0:18:12]: Which is this piece of property here is in the overlay. [0:18:13, 0:18:20]: Because this property already had frontage off of an old road, it was never seen as being along the corridor of [0:18:20, 0:18:23]: Highway forty two, that's why it wasn't designated. [0:18:23, 0:18:29]: as part of the overlay district because it didn't have any frontage on and there was a road separating it from [0:18:30, 0:18:31]: From the highway. [0:18:31, 0:18:34]: So that's the reason why it wasn't included in the overlay district. [0:18:35, 0:18:40]: So only a small portion of the property is actually in the overlay district, which is track number two. [0:18:41, 0:18:56]: Now the applicant, I guess, could decide whether or not they want to comply with some of the with the route regulations as it relates to, but the portion that they're proposing to put the storage facility on, proposed storage facility on is actually zone C three and it's outside of the overlay district. [0:18:58, 0:19:01]: They are reflecting ten foot sidewalks along their property boundaries. [0:19:02, 0:19:16]: Um pretty much along the exits there are no sidewalks existing on that side of the road as of today. So this will be the first segment. If if approved, this will be the first segment that'll start that ten foot sidewalk on the [0:19:16, 0:19:20]: north side of Davis Road. There's sidewalks on the south side of Davis Road on the [0:19:20, 0:19:22]: Walm outside, those are five feet. [0:19:22, 0:19:24]: This would be ten feet on the opposite side. [0:19:30, 0:19:45]: I guess the confusion was again when they when they do open up and the road is actually widened, they it's going to accomplish the same task. But again, I guess it's on a technicality that it will have frontage on North Henry Boulevard. [0:19:51, 0:20:00]: Because the building will be actually if you look at the rendering that you're giving, man, it will be feet from North Henry Boulevard and so will the parking spaces. [0:20:01, 0:20:07]: on that side angle'cause it's it's fronted toward Davis Road, but look at the side of the building. [0:20:07, 0:20:18]: The parking lot is right literally right there bordering North the future North Henry Boulevard. So yes, they will have you'll be able to see them from North Henry Boulevard of Highway forty two. [0:20:19, 0:20:28]: they won't have an access off of Highway forty two, onto Highway forty two at all. Their access is coming off of Old Atlanta Road. But let me go through this exercise. [0:20:29, 0:20:31]: So this is what we're talking about right now. [0:20:32, 0:20:37]: So this road is now going to be a line. Old Atlanta Road is turning right here. [0:20:39, 0:20:48]: Actually turning there. It's no longer going down at this funky angle close to the intersection. Davis Road is going to be proposed to go similar to this angle here. [0:20:48, 0:20:50]: So those roads are being [0:20:51, 0:20:52]: Realign. [0:20:55, 0:21:03]: Right. And in the end of this, what's going to happen is what is proposed is that that section along Davis Road will be used for the parking lot. [0:21:04, 0:21:11]: So they have yes, two parking lots, they have a parking lot. So we right back in the highway corridor with a parking lot for the building. [0:21:12, 0:21:15]: So as it relates to the so I can show you all [0:21:52, 0:21:56]: So here's the property in question. This property here is in the PMU. [0:21:58, 0:22:00]: They're a remnant piece of property. [0:22:01, 0:22:05]: That's right there is not in the PMU. [0:22:06, 0:22:09]: Everything else in that area is in the PMU overlay district. [0:22:10, 0:22:12]: This is in the overlay PME district. [0:22:12, 0:22:16]: This is the piece where they're proposing the C three. It's not in the PMU. [0:22:18, 0:22:23]: Okay, so what you're saying pretty much is the abandonment is in that top section. [0:22:24, 0:22:44]: This is the bondament here. So the top section there is not uh in the parkway overlay. That is correct. But the future plans call for a parking lot along Davis Road for this business that is in the parkway court. So what there will be restrictions placed on the Davis Park Davis Road parcel. [0:22:43, 0:22:56]: Not allowing that because it's in the parkway corridor, sir. Or they ask have to ask for a variant. Sir, this piece of parcel here is their remnant parcel. As you can tell, there's no PMU requirements under that parcel. [0:22:56, 0:23:12]: I I'm talking about the I'm talking about the section that fronts Davis Road for future development. The one that fronts David Road Davis Road is in the parkway over Lake Hart. So what is planned for that? This parcel here, sir? No, no, the parcel that fronts Davis Road. [0:23:12, 0:23:15]: Davis Road. That piece right there. Crack two. [0:23:15, 0:23:16]: That track too. [0:23:16, 0:23:21]: Right there, track two obviously has nothing in it. There's nothing there. It's a vacant track of property. [0:23:21, 0:23:41]: Right. So what I won't don't want to happen is for us to uh abandon this land and then for them to at some point put another parking lot right there which will give frontage which will basically bring it all the way up to Davis Road and then North Henry Boulevard, which is in the parkway corridor. Right. [0:23:41, 0:23:57]: So according to staff, they cannot put a parking lot on track number three. That's not allowed to put a a parking lot on track number three. Now they could fit a Dave and Buster's ice cream shop on that piece of property. As you can tell, that property is high is triangular shaped. [0:23:57, 0:24:00]: And you see the building footprint of that building. [0:24:00, 0:24:03]: Of that property right there makes it almost [0:24:03, 0:24:04]: Almost unusable. [0:24:05, 0:24:23]: Now, I say Dave and Buster's cause you know Daven Buster's ice cream is a little small, a little two sharks. So it's it's not it's not a track that that's a highly buildable track, but can it be? Yeah. If you're gonna build something small like that, you probably could fit it on there. [0:24:24, 0:24:30]: Um, but in essence, whatever gets built in there would have to conform with the requirements of the PMU. [0:24:34, 0:24:42]: Do you understand? You understand what I'm saying? Which is not allowing the parking lot to be put. Not allowing a parking lot to be put there. Yes, sir. [0:24:44, 0:24:53]: So as you can tell from this plan that they that they have here, all their parking is located um close to the building up here and here and as [0:24:53, 0:24:57]: Most folks know in storage facility they don't have a lot of parking per se. [0:24:57, 0:24:58]: Um [0:24:59, 0:25:07]: And my understanding of this is it's highly in it's all interior. It's not your typical old section um [0:25:07, 0:25:11]: storage facility. But like I said, as it relates to the two acres [0:25:11, 0:25:31]: That that's uh literally just under an acre of property when you consider it. Nothing can get built over here because there's no buildable area here. The buildable area that they have is what you see in that dotted line right here is considered their buildable area. Yeah, th that's what I'm saying. See, I don't wanna get to the few point where [0:25:31, 0:25:51]: The building is expanded into this area or the parking lot is expanded into the area. That is not I think that should be the conditions. So that building can't go in that area. They cannot. Right, that's what I'm saying. I think that's a good idea. [0:25:51, 0:26:11]: toward North Enry Boulevard and they cannot put a parking lot there, which is expand the parking lot for the existing building. It would be it would need to be another, it would need to be, as you suggested, another business there on this particular low low point. Your current code, your PMU, [0:26:11, 0:26:14]: [1575.5, 1588.7]: a storage facility in there so they cannot expand into that area. It restricts a standalone parking in that area so they can't do it. Okay. Um so you could put a condition, but you're conditioning what's already prohibited under the code. [0:26:29, 0:26:34]: But that's fine. Um and this is not a rezoning, so I d you can't put a conditional zoning on it. [0:26:34, 0:26:38]: 'cause it's not a rezoning. It's just the abandonment portion. [0:26:39, 0:26:59]: Say again that track is not even part of the project, it's just reference on the survey. Right, but it's actually still in the PMU. It's it's owned by that track, I think, is still coming by again. I just want to make sure that there's no there's no uh anything else that's been planned for this area. They're not expanding on expanding the building or the parts. [0:26:59, 0:27:03]: parking lot in this area. If that is the case, then that's pretty much all we can do. [0:27:04, 0:27:07]: Your your current code, your PMU restricts them. [0:27:07, 0:27:12]: moving in that direction that you just explained. They cannot expand into area number two. [0:27:13, 0:27:15]: They can't do that's just yeah, I get it. [0:27:16, 0:27:20]: It they cannot expand in that area because that's covered by the PMU, it's restricted. [0:27:21, 0:27:41]: Um, if they wanted to stay anywhere within track one to do any expansion, that's totally permitted because it's outside and it's zone C two, C three, as long as they can meet the parking requirements as required by the zoning district, that's it. They can only move within the footprint of that buildable area, which you currently see in the dotted line right here through here. [0:27:42, 0:27:43]: And through here. [0:27:43, 0:27:54]: That's the buildable area. They can move to shift the building back and forth in that area all they want, but they cannot go outside of that area without coming before you for a variance. Yeah, it's it's pretty clear that this was pretty smart. [0:27:55, 0:28:05]: I mean you beat you're gonna have a storage building in along North Henry Boulevard because you thought before you thought outside the box and beat us to the punch. [0:28:06, 0:28:07]: Any other questions at all? [0:28:09, 0:28:12]: This is my district. [0:28:13, 0:28:29]: Okay. So Michelle was what I asked was for additional information be sent to me. It wasn't sent to me. We didn't get any additional information. Additional information was not sent to me by staff. That is what the directive was. Ma'am, we didn't get any additional information. [0:28:29, 0:28:41]: only responded to Councilman Alexander just like you're discussing with him right now. He was asking I am responsible for the people who live in this district. [0:28:41, 0:28:43]: I have asked for over a month. [0:28:44, 0:28:47]: Since Miss Battle called me more than a month ago. [0:28:48, 0:28:51]: I asked specifically about this information. [0:28:51, 0:28:53]: What I don't like is being blindsided. [0:28:54, 0:28:58]: What I've asked is that staff provide routine updates. [0:28:58, 0:29:03]: regarding anything that's going on in city council district four. [0:29:03, 0:29:10]: I don't like coming to these meetings and having other council members speaking to my district. [0:29:10, 0:29:13]: about information I should be provided. [0:29:15, 0:29:20]: I don't wanna be provided information by a council person who's only shared what he wants me to know. [0:29:24, 0:29:26]: I cannot support this. [0:29:26, 0:29:29]: I won't support it, it's based on principle. [0:29:29, 0:29:40]: I understand the whole abandonment idea. The city doesn't have any use for this particular piece of parcel. I get it, but it's about principle. [0:29:40, 0:29:45]: I'm not going to allow no one on this council to disrespect me. [0:29:45, 0:29:47]: Я намна конала стаф. [0:29:47, 0:29:49]: To disrespect me either. [0:29:50, 0:29:52]: I've sent a n I've sent [0:29:52, 0:29:53]: Two. [0:29:54, 0:29:54]: Emails. [0:29:55, 0:30:00]: I've gotten couple of calls or contacts from Miss Battle. [0:30:00, 0:30:01]: And still nothing. [0:30:03, 0:30:04]: This storage facility. [0:30:05, 0:30:08]: Із рай і недол' резиденціл. [0:30:09, 0:30:16]: There's commercial on the other side, but those residents deserve to know what's happening in their district. [0:30:17, 0:30:23]: We're not sending out newsletters, you're not providing updates to the council person who's supposed to be representing them. [0:30:24, 0:30:39]: That's what I'm upset about. So I can't support it. I won't support it. And I know there's other development that's going on there. However, I'm not being apprised of what's happening here. Seems like at least one council member knows, not me though. [0:30:41, 0:30:46]: [1846.6, 1866.6]: I had not have any contact to discuss these items. I wanted to discuss them in public because I raised this contention when it was brought up here the first time is that this facility in general would not have been allowed if this was in the Parkway Corridor. Staff has clarified the parking lot. [0:31:06, 0:31:26]: And is the parking this particular parcel that is owned is in the in the parkway mixed use district. That was just clarified tonight. There was no other discussions by myself. My contention in discussing this was was this allowed in the parkway corridor? And staff has attempted to [0:31:26, 0:31:46]: Correct that, but certainly there hasn't been any discussions outside of these to uh to discuss this. I was with I was the one who spearheaded the highway corridor plan all over the city. That's why I know that this was a potential issue because it sets standards not just in my district, it sets [0:31:46, 0:32:03]: standards all over the city for the ten foot path, the frontage, the back, the front setback, the side setback. It said everything for that corridor and it specifically prohibits certain businesses from going along major corridors. That's why I asked the question. It had nothing to do with where it was located at. Thank you. [0:32:03, 0:32:08]: Any any further questions for the council? We're good? Oh yes, ma'am, go ahead, please. [0:32:08, 0:32:15]: Where where would the unit start? It won't be on the frontage of the road, would it? [0:32:15, 0:32:27]: Do would the plan be I I mean, I'm trying to figure out where the units would start and would the would they be willing to work with us to make sure that it's really not visible from that front frontage portion of the road. [0:32:28, 0:32:30]: So my understand [0:32:31, 0:32:33]: Miss Battle. I think Miss Battle is [0:32:33, 0:32:53]: First of all, um thank you all for taking this matter up. I know this is the second time that you all have dealt with this. I was not able to attend at the last meeting as I was out of town on vacation. So um I feel like I'm stepping into the middle of something that I was really not aware of other than what my associate told me. Um we have been working on this matter. [0:32:53, 0:33:13]: Now for a couple of months. We started out asking who was responsible for doing right-of-way abandonments. Because from our perspective, the client's perspective, the property is currently zoned to allow for a self-storage facility. But for this, they wouldn't even, we wouldn't even be here. This would be going [0:33:13, 0:33:21]: Going through normal process, getting an LD. I think they had, in fact, already submitted for their LDP, and they were moving forward because. [0:33:21, 0:33:27]: It is a permissible use under the zoning ordinance. So anytime you got a permissible use. [0:33:27, 0:33:40]: You don't come before here. There's no notices. You just see the the sign for construction or whatever that goes up. And that's that's all there is. But because this right of way had been abandoned, they felt that [0:33:40, 0:33:44]: It was better suited for them to take ownership of it. [0:33:44, 0:34:04]: so that you don't end up with dumping in the road bed still left in there. I don't know if the city was gonna try and put some type of physical barrier over there, but nobody wants that. That doesn't look good. And what they didn't want was people just kind of driving down that road and it just ends and there's nothing to happen on that street. [0:34:04, 0:34:13]: And they don't want it to look bad. So they thought that it made more sense for them to incorporate it into their project so that that was not an issue. [0:34:14, 0:34:20]: The property that is in front on track one, I just asked the client, their intent on that. [0:34:20, 0:34:26]: is to place a retail center on that property that will be in alignment [0:34:26, 0:34:27]: With what's in [0:34:28, 0:34:31]: the overlay district. So if that's allowed, I just asked staff. [0:34:31, 0:34:51]: If that's allowed in the overlay. So they are more than happy to work. I know the Economic Development Department, I've been trying to get clients to work cooperatively with them to find the types of retailers that you all might want within the city, because I know you all have a vision for what you all are trying to do. So we know. [0:34:51, 0:34:55]: I think it's T Dallas Austin who I I know well. [0:34:55, 0:34:57]: Ам Isto work with him. [0:34:57, 0:35:10]: um when he was at H. J. Russell and Company. So I know that company and we are more than happy to have them work cooperatively to get the type of retailers that you all might like. But they're not that far in the process with regards to that. [0:35:11, 0:35:16]: All they want to do is to abandon that little portion of the of the site. [0:35:17, 0:35:17]: Um [0:35:18, 0:35:38]: And to place the building itself would be on the track that is already, as I said, currently zoned and allowed for that use. To the extent that I don't know if staff is seeing the building elevations or anything like that. I don't even think they've gotten that far. So those are things that we certainly as we're [0:35:38, 0:35:58]: Going through that process, comments from the commissioner for the district, all those kind of things. To the extent that that's part of the process, we're more than happy, you know, to work through that process with you all. Um, but the intent here is not to do anything that violates the overlay or the the highway corridor portion that you all have worked so hard on. There's no intent. [0:35:58, 0:36:01]: there. But they they are allowed to do [0:36:02, 0:36:05]: the self storage facility because that's what the property is owned for. [0:36:05, 0:36:25]: Or that's what the property allows under its current zoning. So that's the only thing. That's the only reason why I came here. We went ahead, we got the appraisal that requires them to actually pay for this property. And so the appraisal has been submitted to you all. And I know that you all don't do right-of-way abandonments all the time. [0:36:25, 0:36:42]: So we appreciate that, you know, there was, I think staff was trying to figure out well who who does what, but we've worked um with staff, um, public works in order to make sure that we responded to the questions that they had with regards to this process. So um [0:36:42, 0:37:02]: Councilmember Barber, I know we had attempted to reach out to you to have discussion about it. And then I know that um Josh last or a couple of days ago sent you some additional information about the project to give you more information. I'm not aware of what you all do from a staffing perspective, of what you need. [0:37:02, 0:37:22]: Needed or what you wanted from them. But we have been circulating this information, the site plan, the um plat, um, all the information from GDOT because the road has already been abandoned and they've already relocated, to my understanding. So all this work has been done. All that's left is this remnant road that's just sitting. [0:37:22, 0:37:42]: there um that once again we don't want to become a dumping ground um in front of this facility. So we are hopeful that we can get this done. I hate that you know we're kind of in the middle of what appears to be some disconnect between Councilmember Barber and staff, but I hope that my client does not get penalized. [0:37:42, 0:37:55]: because of any disconnect on that front, because we've tried to do everything that we were supposed to do to bring this forth appropriately. Because there wasn't a we even when we looked in your code, there was not a set [0:37:57, 0:38:02]: process like there's no application. There's no, you know, that may be something you all choose to look at. [0:38:02, 0:38:22]: uh in other jurisdictions where I do this, they have one person that kind of deals with this and then they go through a process and inform everybody and all that kind of stuff. But you all don't do this that frequently. That's more so on the county's sides when they're having to do these abandonments. So um we are just hopeful that we can go ahead and and and get this done because my client has been waiting. He's got some contractual obligations. [0:38:22, 0:38:30]: And that they're trying to meet some deadlines. And, you know, it's been a minute because we started this, I think, back in [0:38:30, 0:38:32]: My goodness, I think we sent this over in [0:38:33, 0:38:34]: July. [0:38:35, 0:38:55]: August and we're just now kind of getting around to this moment. So thank you for your presentation this textbook. If I may respond. Yes, you can just say that one step. Thank you. Thank you for everything that you've done and and hopefully you enjoyed your vacation. Got clan, so just clear your head. I did. It was my work. Get back to business. Go ahead and Councilman Barber. [0:38:57, 0:38:58]: I have the floor now. [0:38:58, 0:39:05]: Uh yes, you can go now. Thank you, Miss Battle, for being here. Um and thank you for reaching out to me. You're absolutely right, there is a disconnect. [0:39:06, 0:39:06]: Um [0:39:07, 0:39:13]: I expect that staff will provide me with information before talking to any applicant. [0:39:13, 0:39:15]: Regarding any proposed project. [0:39:16, 0:39:16]: Um [0:39:17, 0:39:19]: The council voted [0:39:19, 0:39:20]: Uh [0:39:20, 0:39:24]: Капла єрського, да whenever a application is submitted. [0:39:24, 0:39:26]: By business. [0:39:26, 0:39:30]: That we be if it is approved or acceptable. [0:39:31, 0:39:33]: The ones that you all don't have to bring to the council for approval. [0:39:34, 0:39:36]: We want to be apprised of that. [0:39:37, 0:39:39]: Now that we have districts, I'm responsible. [0:39:40, 0:39:44]: To provide answers to those residents and business owners in the area. [0:39:45, 0:40:05]: What I've asked, Mr. Gardner, I've seen you mouthing over here. So if you have any questions, you can stand up here. I don't mind us having some discussions. I'm directing my comments to staff. Oh, okay. But you seem to be pretty disrespectful over here in the corner with your frowns. Okay. Nonetheless, I asked. [0:40:05, 0:40:13]: Multiple times of staff to provide me with details in regards to whatever it was Ms. Battle was sending to me. [0:40:14, 0:40:15]: I didn't get anything. [0:40:15, 0:40:16]: What I did get [0:40:17, 0:40:23]: Um on I guess Friday was an email that Mr. Alexander forwarded. [0:40:24, 0:40:28]: From community development with the city manager on copy. [0:40:28, 0:40:30]: He forwarded to the council. [0:40:31, 0:40:37]: The directive at our last meeting was that the city manager appris the council [0:40:37, 0:40:39]: Representative of that area. [0:40:40, 0:40:41]: Of what was going on. [0:40:42, 0:40:45]: To provide me more information. That didn't happen. [0:40:46, 0:40:49]: Other than what I just heard here today. [0:40:50, 0:40:52]: That is not the way we should do business. [0:40:53, 0:40:54]: It is not. [0:40:58, 0:40:59]: Respectfully. [0:40:59, 0:41:09]: The information that was submitted in the zoning pa in the abandonment pocket that came to you guys included everything that staff had gotten up until today. [0:41:09, 0:41:17]: Right. I cannot control if somebody sends an email back and forth because obviously I get a thousand emails. [0:41:17, 0:41:18]: All right. [0:41:18, 0:41:23]: But as it relates specifically to the democ the dimensions of this project. [0:41:23, 0:41:34]: The abandonment of this project, the appraisal of this project that was asked for, those things were provided to this council as a whole last week or the week before when the pocket came to you guys. [0:41:35, 0:41:35]: Right? [0:41:35, 0:41:45]: We've done our best to apprise you guys of all of the zoning issues that come in, but once again, this this no it's not a zoning. This came through as an abandonment through the public works department. And so my apologies [0:41:46, 0:41:48]: For us not getting that information out. [0:41:48, 0:41:53]: I've already informed the staff that we'll be sending out that general information, whatever it is that's happening. [0:41:53, 0:41:58]: Бо іти з дифорфою і сам вус и мофис і ся ам тим а. [0:41:58, 0:42:00]: Floating a balloon on [0:42:01, 0:42:02]: First street. [0:42:02, 0:42:09]: And then it doesn't happen. And I send that to you, you're gonna ask me what happened to the balloon. Well, it didn't happen. They didn't apply for a permit, it was a thought. [0:42:11, 0:42:12]: A concept. [0:42:13, 0:42:16]: Right? The time it takes to do that for everybody's district. [0:42:18, 0:42:22]: We only t send it for information when concrete stuff comes before us. [0:42:22, 0:42:26]: Not the fact that somebody walks in my office and says, I'm thinking about doing something. [0:42:27, 0:42:32]: I might put that in there that I met with a certain person, but until they submit something concrete to us. [0:42:33, 0:42:36]: Why am I gonna flood you guys with that type of information that it might not bear fruit? [0:42:40, 0:42:54]: But we put together the pocket that included all of the information that we were given. I asked them if they had elevations of the project and that if we got those elevations from them that I would submit it to everybody. I did not get any elevations. So I therefore I had nothing to submit. [0:42:55, 0:43:05]: They are you asked for presentation, so staff put together the pre this this to include information that you already had in your pocket to kind of put it in a presentation format. That's what was asked for when we did that. [0:43:07, 0:43:14]: When this information was provided to um me or brought to my attention by Miss Battle. [0:43:14, 0:43:19]: I don't know if she was speaking about this or some other proposed development. [0:43:19, 0:43:22]: But you know once a permit has been filed for. [0:43:23, 0:43:24]: I wanna know. [0:43:25, 0:43:28]: Whether it's approved or goes through the full process. [0:43:29, 0:43:30]: I wanna know. [0:43:30, 0:43:34]: And that is the discussion that the council had каплис-го. [0:43:35, 0:43:38]: What I do not want is any other council member. [0:43:39, 0:43:44]: having influence on what's going on in my district without me knowing what's happening. [0:43:45, 0:43:50]: I know that this is not the o only development that's coming to that particular area. [0:43:51, 0:44:01]: It's clear to me, although you all still have not provided me with any information on proposed developments that are being discussed in that area. [0:44:01, 0:44:07]: I know that there is. The second point I wanted to make is there is a public storage facility. [0:44:08, 0:44:09]: About a malloway. [0:44:11, 0:44:21]: So are we only is our vision only to uplift those that live off the Jodico Road and Walt Stevens Road area? What about the other areas of our city? [0:44:21, 0:44:28]: that needs to be revitalized. Is a public storage facility all that we have that we can bring to the area? [0:44:29, 0:44:37]: Those are the kind of statements and questions that I get all the time. So since you're sending me out here by myself to try to explain to the public. [0:44:38, 0:44:40]: What plans we have for that area? [0:44:40, 0:44:44]: I'm asking for answers from staff first. [0:44:45, 0:45:04]: I asked months ago. Relax for a second. Point of order. I asked months ago and I got no answer. Along with several other emails that I've been sending recently and I'm not getting responses. So I don't know if staff is being told not to respond to my emails. They are point of order. But it needs to stop. [0:45:04, 0:45:14]: Today. What's your point? What's your point of order? If there are any um uh we are a body of um [0:45:16, 0:45:23]: Civics, civilization. Um, if there are any complaints in regards to [0:45:23, 0:45:43]: um staff or disgruntle agreements. That's something that we can talk about in executive session. At this point in time losing battle. Could y'all just go along at this point in time, what we are supposed to be talking about is this particular issue that's on the floor right now, that's on the agenda. And I think we have strayed far away from that. [0:45:43, 0:45:50]: We are now in a broad spectrum in regards to districts and who can say what about people's districts. [0:45:50, 0:45:53]: And I think that we need to go back and narrowly [0:45:53, 0:45:58]: discuss what the agenda item issue is as of right now. I think it's gotten [0:45:59, 0:46:02]: Um, a little bit out of hand in regards to finger pointing. [0:46:03, 0:46:07]: And blaming and um we did get this information last week. [0:46:07, 0:46:08]: That's why we [0:46:08, 0:46:12]: We got we postponed to get additional information which we've received. [0:46:12, 0:46:17]: And so it you know, I just think that we need to narrowly scope it back to the agenda item. [0:46:18, 0:46:30]: I concur with that I would ask to speak next because I wanted to clarify something. Staff did not reach out to me. I proactive staff was responding to an email that I sent. [0:46:31, 0:46:32]: After our meeting [0:46:33, 0:46:53]: I had some concern about this project being located in the highway court. So I asked staff that question. I proactively forwarded the message to the rest of the council because of my concern, because I had reached out. Any individual council member could have done the same thing that I did. [0:46:53, 0:46:58]: I did. I did as well. What part of that don't you understand? I didn't hope I got no answer. [0:46:58, 0:47:00]: Not only that, I [0:47:01, 0:47:04]: What actually happened was I was dismissed. [0:47:05, 0:47:12]: I was told that, oh well this applicant knows the process. I'll I'll talk I'll reach out to them. [0:47:12, 0:47:13]: That's all I got. [0:47:14, 0:47:27]: That's all I'm saying. I wanted to know specifically listen, what I'm not going to do is sit here and play games with any of you on this. This is something that is affecting the district that I am representing. [0:47:27, 0:47:33]: So to send information to the council as a whole, that's great. But do you not think [0:47:33, 0:47:35]: That it would be respectful. [0:47:35, 0:47:55]: of the person who's representing the district to at least get the information first or at least be apprised of the information mayor first. Because that never happens in my district. Mayor. While you all are discussing order again the district that I represent. You're leaving a person out of it. Mayor supposed to be speaking for the people who live in [0:47:55, 0:47:56]: Yeah. [0:47:57, 0:48:07]: So I'm not gonna keep playing these games with you all. I am not. What I'm expecting is for staff to do the job they've been hired to do. [0:48:07, 0:48:27]: To point of order. What I'm expecting is discussing interference. Executive sessions. That's what I'm expecting. Now, we all had a week to go and call and ask our questions. [0:48:27, 0:48:47]: We knew this was coming up. We postponed. We heard all the information, the last meeting. There's no need of us throwing blame and crying out victim because we all had the opportunity to ask our questions. I call Mr. Gardner myself and ask questions. It doesn't matter. [0:48:47, 0:49:00]: Three years ago, two years ago, we didn't have districts. I don't look at Stockbridge as districts. I look at it as our responsibility to make sure that we are doing what's in the best interest of Stockbridge in general. [0:49:00, 0:49:20]: I made a motion last week to postpone because I was uncomfortable out of respect of the comments that Councilwoman Barber made and the questions she had. Councilwoman Barber can pick up the phone like everybody else. We get a paid cell phone by the city. And she could have called our uh called Mr. Gardner and if she did, if she didn't still understand it. [0:49:20, 0:49:40]: Call and if she didn't understand it, so be I'm not gonna play these games. I'm not going to allow you to keep playing Mayor Ford. You can move this meeting along. Move this meeting along. We're not. Let's vote on the item and move it along. What I'm not going to do is keep sending emails after emails calls after calls for them to ignore me. [0:49:40, 0:49:45]: Calm down. Calm down. Carry on with this meeting. Calm down. [0:49:46, 0:49:50]: Calm down. All right. Mr Gardner, come back to the podium, please. [0:49:51, 0:49:52]: All right, now [0:49:53, 0:50:08]: Yes, we have districts. Every we have district representation, but it's still a concern that even though you have districts and you have representatives for districts, the entire council has concern about the entire city. And hold on, don't tell me to move on. I allowed you to speak plenty. [0:50:09, 0:50:15]: Now what it amounts to, if anybody has any concern about things going, I'm the one that it's voted on city wide. [0:50:15, 0:50:20]: Period. We all part of the team. It's always been that way. Hold on now. Did I interrupt you? [0:50:23, 0:50:40]: We're all part of a team, regardless. No matter what you represent, we're all part of a team elected by the people. We need to represent the people properly. And obviously obviously the staff's do gotta do their job. There's opportunities and things for for you to talk to the staff, call the staff, filter everything through the city manager. That can be done. [0:50:40, 0:50:42]: Always she's always available. [0:50:42, 0:50:45]: If he's not to keep working with it or come here to visit. [0:50:46, 0:50:50]: Well we gotta make clear we run things and do things properly here, folks. We're getting out of hand. [0:50:51, 0:51:00]: And y yes, I put some managing meeting, but it also takes your control and your assets and your concern for one another and respect for one another to make sure we're doing things right. [0:51:00, 0:51:02]: All right? So listen. [0:51:02, 0:51:07]: Yes, we have council districts. I got that. But regardless of that. [0:51:07, 0:51:13]: We all have a interest special interest in what goes on in the city, period, because not one person, not even I. [0:51:13, 0:51:20]: Have mass control. I don't have total control. None of us have total control. It's all team effort. It takes three to move anything. [0:51:21, 0:51:23]: Whether I like it or not, it takes three. [0:51:24, 0:51:29]: We need to understand that. It's a team effort, always a team effort. And mom always talking about team. [0:51:29, 0:51:47]: I'll move on when I'm ready. I'll move see now you want to be argument. I didn't need to be able to do that. I don't need you lecturing me, that's for sure. I'm not well. We have a sensor at this. Wow. Okay. Let me if I could stand by one stand by one second, please. Okay. [0:51:48, 0:51:55]: Uh Mr. Gardner, I'm sorry about all this happening the way it is. You just gotta maintain your composure as best as possible. You and the staff. You just gotta continue to do that, sir. All right? [0:51:56, 0:52:16]: Mr. Alexander, go ahead, please. Yeah, so uh to get us right back on target. The options are to abandon this property or not to abandon this property. So what are the other options? If the city does not choose to abandon the property, then what are the options we what are the other options? We turned it into a [0:52:16, 0:52:23]: A pocket park, we maintain it. What are the options? If we use it as an easement, what are the other options so we have everything on the table? [0:52:27, 0:52:35]: Just about this subject. That stretch of road that you see in front of you, if you if if the council chooses not to abandon it. [0:52:35, 0:52:42]: We will have to maintain that little strip and perpetuity until such time that the city sees that it wants to abandon it. [0:52:42, 0:52:46]: And if the person that owns the adjacent property on both sides of it wants to take it. [0:52:47, 0:52:48]: Um [0:52:48, 0:53:08]: The other effect of that is obviously we know that this has been an area where homeless folks have been encamping along that Davis Road area. Obviously, that takes this location with the development of the property takes it off the map for folks to be homeless and hiding in the bush. Um, the public works director could tell you that we've spent time and effort um cleaning [0:53:08, 0:53:09]: Yeah. [0:53:09, 0:53:24]: Um and Councilmember Barber knows that when she gets the call and we get the call, we go out there and we try to clean up and those folks go into the tree line in that area right there. Um so that's always an issue and that that will if that road is abandoned, it's probably gonna become a haven for those folks to come back to. [0:53:25, 0:53:40]: Um if it's not, it's gonna be there. And obviously we'll have to to um barrier it off at this point, um right about here. Mm-hmm. It'll have to the rotor is turning right there. [0:53:40, 0:53:47]: Right. That that think that store is now gone. But right along this area where the road turns and goes towards [0:53:48, 0:53:50]: No, Henry Boulevard right there. [0:53:50, 0:53:54]: Okay, so so that stretch from pretty much from right there to here. [0:53:55, 0:54:00]: we would have to put a barrier up right here. Um GDOT is already creating a barrier on that end. [0:54:01, 0:54:05]: And so we will be charged with maintaining the right of ways in this area. [0:54:05, 0:54:06]: And obviously, you know. [0:54:07, 0:54:09]: What's gonna happen is folks gonna come there and they're gonna dump or they're gonna [0:54:10, 0:54:12]: put pitch up home distance'cause it's [0:54:12, 0:54:13]: Behind screening. [0:54:13, 0:54:14]: Um [0:54:14, 0:54:23]: The applicant owns this piece already, this little slither of a piece of property they own, so the road pretty much bisects their property on both sides. [0:54:24, 0:54:32]: Um so obviously from their standpoint it makes sense to control that whole piece of property, incorporate it as part of the project and make it happen. If not, [0:54:32, 0:54:35]: Obviously you can tell from the diagram, they can walk around it. [0:54:36, 0:54:37]: Um [0:54:37, 0:54:38]: And we'll have to maintain it. [0:54:41, 0:54:44]: Mr Thomas, you haven't said anything. Do you have any comments there at all? [0:54:45, 0:54:48]: Uh I I do not mayor um [0:54:51, 0:55:03]: What I really wanna say, uh uh I'm not going to say because it sort of just goes back into the argument part of it. But I do wanna thank Mr. Gardner um for that explanation and [0:55:05, 0:55:06]: I'll just say that [0:55:07, 0:55:27]: We all are concerned about the city. And it's always a uh a group decision on anything to move. And I just want us to keep that in focus that and as you indicated, Mayor, it does take us as a team, it does take a consensus of council to move any agenda item. And I just think we just [0:55:27, 0:55:38]: need to sort of be a little bit more understanding and be a little bit more cordial. Um and you know, and I think Mr. Garden sort of indicated too when it comes to the staff. [0:55:39, 0:55:40]: So we just have to try to [0:55:41, 0:56:01]: uh work together as a counselor and as a staff to get the best information. And so that's the reason I asked Mr. Gardner uh about the other item. He said that um the staff needed to do some research and I would just encourage was that information coming back to the council. But you know, just basically we we just need to understand [0:56:01, 0:56:09]: Understand our role, understand the role of counsel, understand the role of staff, and put that together and be more efficient. [0:56:09, 0:56:11]: more effective [0:56:11, 0:56:31]: In moving our great city forward. And that's always been my concern. And I always talk about uh processes, procedures, and and I think when we sort of stay in that area, in those boundaries, then things really move forward. Thank you, Mayor, for asking. You're welcome, sir. No problem. On that note, I would imagine we have [0:56:31, 0:56:38]: I have a comment I'd like to well question I'd like to ask Mirror Four. [0:56:38, 0:56:42]: My hand was raised. As usual you ignore me, so I have to assert myself. [0:56:43, 0:56:45]: Mr. Gardner, that little side street. [0:56:46, 0:56:50]: Um is that the side street that leads to the residential homes back there? [0:56:51, 0:56:58]: Because there is a subdivision or neighborhood back there. So how do those residents exit? [0:56:58, 0:56:59]: Their neighborhood. [0:57:00, 0:57:02]: If that street is [0:57:02, 0:57:03]: Closed off. [0:57:03, 0:57:04]: Yeah, just take it back. I don't [0:57:10, 0:57:11]: It's not shown up up here. [0:57:12, 0:57:13]: So we can't see. [0:57:15, 0:57:24]: Excuse me. So the road, Old Orlanta Road that they were using to access off of, it's actually going to turn like I mentioned. It's gonna turn and it's gonna go [0:57:26, 0:57:28]: Uh go back opposite way. [0:57:32, 0:57:34]: The road actually goes turns right about here. [0:57:36, 0:57:38]: And goes out to [0:57:38, 0:57:45]: Or um out out to Highway forty two right there. Okay, so there will be only are they able to turn left and right? [0:57:45, 0:57:49]: When they exit from that point, when they get to North Henry Boulevard. [0:57:50, 0:57:51]: To forty two. [0:57:52, 0:57:57]: This access point that you just shared next to this dentist office. [0:58:02, 0:58:03]: Will that be accessible? [0:58:04, 0:58:11]: So right here, we see where this is the road now that everybody uses. They come straight down that road and goes to [0:58:11, 0:58:22]: to highway forty two. So the road turns right where I showed you that building is. So they'll be able to turn, come out of their subdivision, come down the road, turn and go either north or south. Um [0:58:25, 0:58:26]: Well, they're gonna be able to just go north. [0:58:27, 0:58:33]: on North Henry Boulevard, does this look like this is a median right here. So they can only do right in and right out. [0:58:33, 0:58:34]: As I thought. [0:58:35, 0:58:45]: Thank you, sir. Yes, ma'am. And as it relates to the property as a whole, Miss Barber, when it comes down to it from we don't recruit, obviously I think as Miss Battle said, [0:58:46, 0:58:51]: Everyone here that owns property has rights in those properties, whether it's a house or business or raw land. [0:58:52, 0:58:56]: Right. And what controls that is what it is zoned for. [0:58:57, 0:59:04]: And those zoning costs permitted uses. So if a person owns a piece of property and they want to build a house in its own residential, [0:59:05, 0:59:25]: They're gonna just come and pull permits to build their house once they get the architect. Same thing with a business. If a person owns a commercial piece of property, they're gonna look to come to us to ask, hey, can I put an ice cream shop on this property? It's zone C3 or C2, and we're gonna say yes. And at that point, they're just gonna go ahead and move forward because that's their business. [0:59:25, 0:59:27]: business aspiration for their piece of property. [0:59:27, 0:59:31]: So in a situation like that where we're not out recruiting. [0:59:32, 0:59:33]: Generically things happen. [0:59:34, 0:59:40]: Um and those things happen, and the only time we do see them is when they come in for permits. If somebody's building a house on five acres. [0:59:40, 0:59:43]: That they're just gonna come in when they come to bill. [0:59:43, 0:59:49]: Um there are times when yes, when we can go out if we're part, you know, we see areas that we wanna see get done and [0:59:50, 1:00:09]: you know, those owners um are willing to work with us, especially what we did on Patrick Henry with working with the few landowners that were in the city, we were able to accomplish that. But like small three acre, two acre, one acre tracks like that, it's much more difficult to control or know when that person's gonna bring something in. And that's what makes it difficult. [1:00:09, 1:00:11]: Um from that standpoint. [1:00:11, 1:00:13]: Uh but typically, you know [1:00:13, 1:00:33]: We typically see it when it comes through when they submit for a land disturbance or they submit for a building plan. And that's typically most your generic stuff, how that happens. Um it's not like we're out recruiting anybody specific, but we would love to see certain things come. And if we you know, if the applicant, the owner of the property is willing to discuss with us beforehand. [1:00:33, 1:00:37]: Yeah, that's an opportunity for us to say, hey, we would like to see this in this area. [1:00:37, 1:00:54]: Um and then we try to advocate for it, but obviously it's gotta make business sense for them. Right? Because as much as me w want something to come to our community, if they don't think they're gonna be able to make money off of it, they're not gonna go. They're gonna go with the area where they think they're gonna make money because nobody is in business to lose money. [1:00:54, 1:00:56]: Or to lose whatever investment they put into something. [1:00:57, 1:00:59]: Right, we don't try to operate at a loss. [1:01:00, 1:01:20]: Right. So that's kind of the dynamics of how it happens. Some things we could intentionalize, some things happen generically, and when we try to control it is when it comes through the process. Okay. Are you aware of any other developments that come after this in this same vicinity? No, ma'am, not that I know of, other than what right how that is what made it. [1:01:20, 1:01:31]: Ms. Battle was calling or reaching out to me about. Okay. So I would think that you or Mr. Anderson would be aware of what she was reaching out to me about. [1:01:31, 1:01:42]: So I don't know and I guess we bottle it update. So this is what I mean by I'm blindsided. So I don't work closely with developers. Um I typically wait. [1:01:42, 1:01:46]: Until I've had conversations with city staff about [1:01:46, 1:01:50]: what this is about. Mm-hmm. Yes, ma'am. So hearing from [1:01:51, 1:01:52]: A developer. [1:01:52, 1:01:53]: Um [1:01:54, 1:02:05]: I don't know what to say. Right. And in and in this case, obviously, because this was permitted by right, Ms. Barber, the issue was whether we the city was gonna abandon this piece of roadway or not, right? [1:02:05, 1:02:14]: Um, outside of that, yes, okay, we will uh I've already had the c discussion with Ryan that, hey, this is something we need to make sure we're intentional about doing. But [1:02:15, 1:02:35]: If this road abandonment wasn't part of it, obviously they have the right. They would have developed the property regardless. But like you said, we should notify you that something's coming in the area and we'll we'll we'll make sure we do that. And that's everybody's district moving forward. Um but yeah, I mean, obviously, you know, this we have little or no control. [1:02:35, 1:02:44]: So obviously, of other than the permitted uses that's allowed for them to put on the property. So right now they're proposing to put a permitted use on the property. [1:02:44, 1:02:45]: Um [1:02:45, 1:02:50]: You know, the decision is whether or not the city council wants to abandon the roadway or not abandon the roadway. [1:02:52, 1:02:53]: Oh, right here, please, Mr. Battle. [1:02:54, 1:03:14]: What a point of clarity. Um, Councilmember Barber, it is my belief that when something comes into your district or any of the other districts, and you can ask the other uh commissioners or council members, I call you all and let you know that I have a client that is interested in doing in something in your district, and I try to get feedback. [1:03:14, 1:03:30]: Because I don't like to bring things into districts without having some discussion with the council member to see whether or not it's even worth my client wasting their money to come into an area before going through all the site plans and [1:03:30, 1:03:50]: And all the money because it's an expensive process to go through. So I contacted you a couple of weeks ago because I have a client that wants to do something on the other side, not on this side of North Henry Boulevard, but at the very top end, right before you go into the next jurisdiction, up at the very top end. And [1:03:50, 1:04:10]: I wanted to have some discussion to get some idea as to whether or not that was something that you would even entertain. You indicated that you would prefer to us go to staff, and so that is what we have done. We've gone to staff, we've had a couple of meetings now with staff in order to get some feedback for my client to make some decision as to whether or not they even want to pursue. [1:04:10, 1:04:25]: Pursue the project. Nothing has been filed. This is just discussions. I feel like that is a beneficial thing for my clients to speak to the council members before I start even sometimes speaking with staff. Because I feel like if you tell me [1:04:26, 1:04:33]: Uh'cause I've had this told. I know d commissioners on co council members have told me. Don't even bring that over here, Michelle. [1:04:34, 1:04:54]: Just keep it moving, because I'm not I'm not interested that in my district. So I make that a a a priority for myself and I do that in every jurisdiction that I practice in because I find that that is more effective and it saves time and money. Because truthfully, I don't like losing. It's not worth it to me. I get paid to win. [1:04:54, 1:05:14]: And that's what my job is. And so I try to make sure I I spend my time wisely and my clients' money wisely. So that project has zero to do with what's going on here. That's a totally different developer, that's a uh a residential community, um, and has nothing to do with anything that's going on on this particular right of way. Um [1:05:13, 1:05:15]: abandonment. So I just wanted to make that clear. [1:05:16, 1:05:19]: Thank you, I appreciate that. Ms. Battle, before you leave. [1:05:19, 1:05:25]: Can I ask a little bit? So I just wanna make sure that they are you had mentioned that the [1:05:26, 1:05:27]: Uh developer here. [1:05:27, 1:05:31]: Who's interested in this parcel and putting the storage [1:05:31, 1:05:41]: facility, which they can put anyway. It's the only thing is a little piece of land right in front of that road, right? And then we response for a roadway between that and a storage unit. [1:05:42, 1:06:02]: You're stating that they have an interest in putting retail in the front portion of that on North Henry Boulevard. Is that the thing? Based on everything that's just transpired, what they said is this. They will work with you all if you want to park there. They'll put a park there. They will work with you all with regards to what goes on that. [1:06:02, 1:06:22]: Particular parcel of land. So that is something that I'm committed to. If they tell me that's what we're going to do, we will set up a meeting with staff and council member Barber or whoever else wants to join on to that conversation to talk about what goes in front and what will be allowed on that period. [1:06:22, 1:06:27]: Peace. That is what my understanding is, and I will follow through on that. [1:06:28, 1:06:28]: Okay. [1:06:29, 1:06:30]: Yeah, for [1:06:31, 1:06:40]: Well one second please. Are you you I'm I'm done. Uh Ms. Battle before you take your seat. I I don't have a question, I just have a comment. [1:06:40, 1:06:45]: And and and I do want to just confirm uh the practice. [1:06:45, 1:06:45]: Yeah. [1:06:46, 1:06:54]: of you reaching out to council members. Uh because you have reached out to me a number of times. And even when I walked in [1:06:55, 1:07:15]: You know, you reminded me again. And so, and I and I think that is very good. And again, um for us to to grow as a city, to be more efficient and effective, uh, and I think that is good coming from [1:07:15, 1:07:35]: uh someone that represents uh developers that want to come in. So I'm just sort of just kudos and to you that I appreciate that. And uh and if I don't return a call or email, that's on me. That's okay. I know you guys are busy. And I know you you have reached out to me a number of times and there's a project that's [1:07:35, 1:07:40]: is coming up in a district that I represent. But even though [1:07:41, 1:07:43]: I look at myself as an elected official. [1:07:44, 1:07:48]: that I represent the whole city because citizens come to me all the time anyway. [1:07:49, 1:08:07]: Uh but I just want to say thank you for that practice. I appreciate it. And uh and just forgive me if I don't respond back. But I'm just saying that that's on me. But you and I have agreed that, you know, with this project that's coming, you and I are gonna talk. Absolutely. So I will give you another call. I just wanna say thank you. Not a problem. All right. [1:08:09, 1:08:15]: All right, thank you sir. Appreciate it. Make sure I'm clear left and right. Everybody's had enough to talk so I need [1:08:16, 1:08:20]: Ms. Ryan Anderson. [1:08:26, 1:08:46]: You have been here and you have observed the comments that have been made that then Ms. Gantt's question, which is that parcel which fronts North Henry Boulevard, that tract, that it's been agreeable, that it's basically will be reserved it will be a park or this uh some type of retail development that [1:08:45, 1:09:00]: that would go there, it would not be an expansion of the existing business. That's what you understand. Yes, sir. And it's already protected anyway because it's in the PMU and it wouldn't be allowable anyway. Okay. So okay, I just wanted to make sure we're on the same page. Everybody understands that. Thank thank you. [1:09:00, 1:09:05]: All right. If no other comments in the motion to accept this uh approval. Yes, ma'am. [1:09:07, 1:09:07]: I'm sorry. [1:09:10, 1:09:13]: Need a motion to accept this proposed right away amendment. [1:09:15, 1:09:16]: Some move. Is there a second? [1:09:18, 1:09:19]: Is there a second? [1:09:20, 1:09:22]: [4163.3, 4164.5]: All in favor, please indicate. [1:09:26, 1:09:26]: Okay. [1:09:27, 1:09:32]: I will abstain based on principle. That is my comment. [1:09:32, 1:09:52]: Thank you. We got one final comment. Three three zero one, the motion passed. One final comment. Yes, sir. This area is to be maintained by you all consistent uh with what we would expect of the city, that it would be maintained at the highest level. We don't want to have to come and clean it up and all that kind of thing. Thank you. [1:09:55, 1:10:00]: Thank you. I I need to ask you about one of my business uh I'll not right here. I'll just come to you. It's fine. [1:10:01, 1:10:14]: What we have next is a public hearing. This deals with a text amendment case TX dash two zero two four-zero five citywide. Consideration of text amendment of section two point four point yes, sir. [1:10:16, 1:10:17]: Yeah. [1:10:18, 1:10:19]: Oh yes, ma'am. [1:10:24, 1:10:44]: Okay, once again, this is a public hearing. Text amendment case uh TX dash two zero two four dash zero five citywide consideration of a text amendment of section two point four point four of Stockbridge Unified Development Code UDC to modify the arg uh argument uh excuse me amendment. [1:10:44, 1:10:50]: uh of the regulations for the multifamily resinal residential MFR zoning district. [1:10:51, 1:10:54]: Since it is a public hearing, let me go ahead and finish reading this as well. [1:10:56, 1:11:16]: Public hearing rules. Please mute all cell phones and other electronic devices. [1:12:35, 1:12:44]: We'll have any necessary discussion. If the matter is not tabled, the presiding officer will call for the vote to recommend approval or denial of the request. Mr. Addison, please. [1:12:44, 1:13:04]: Good evening. Uh staff can't we came before you on uh July 30th uh city council work session and uh gave a presentation on uh potential changes to uh MFR district. Uh we added things such as three sided brick, uh thirty foot front yard setback, uh flock cameras, if it's a flock cameras. [1:13:04, 1:13:07]: Gated communities under certain circumstances and um [1:13:09, 1:13:25]: And certain other things to uh to improve our MFR district. It's patterned after the bridges of Jodico um master plan master plan. Uh the the con the requirements that they have for their um town homes. So we feel like [1:13:27, 1:13:40]: This ordinance will improve the current ordinance and make um a product that we can be uh more proud of and more aesthetically pleasing and things of that nature. So I presented this, like I said, at the um [1:13:40, 1:13:47]: July thirtieth, um city council work session and nothing has changed since then. It went to the planning commission, they voted unanimously to approve. [1:13:49, 1:14:09]: Yeah, go right ahead, Mr. Alexander. There were a number of items such as the overhangs would be cons uh consistent with metal uh versus uh the regular shingles. The main roof would be a shingle roof, but then below there yes, we we added that too. You added that the street lights were being added too. Black pole for street lights. Street lights are being added. Um [1:14:08, 1:14:19]: Um other one. Uh he said gated the metal roof. Stand by please. Okay, what about the square footage? We did we work on the square footage? [1:14:19, 1:14:21]: Let me see what the square footage is. I think the um [1:14:24, 1:14:26]: We love the square footage, uh [1:14:28, 1:14:35]: The same as current uh fifteen hundred is the minimum square footage. [1:14:36, 1:14:56]: I think that's been the issue that we keep getting basic townhomes or smaller units and we wanted to get some bigger units in the city. Is there maybe like different classifications of something that could go? Because certainly, as I said, I I think it would be best and wise for all of us to have townhomes equal to single family homes. [1:14:56, 1:15:06]: because the areas get more dense, there's a lot less land, so what they build we want it to be uh uh equivalent to a single family home if town homes are approved. [1:15:07, 1:15:22]: Okay. So you wanna what you want to um I'm saying that what are the options? Are there like different zoning areas or is I gonna refer to all this area on this much land or this much, let's say a um [1:15:26, 1:15:46]: versus a medium density versus a high density or is uh something like that where versus the other square footage d a justifiable juice change to that. I just want there to be some clarification where everybody's not building these small basic townhomes that they're building a better a bigger quality [1:15:46, 1:15:56]: quality product and that is equivalent to a single family home. Okay. So so um if if you were had your way, what what what would be the um minimum size you would like to see? [1:15:58, 1:16:18]: I think if we went up to maybe eighteen hundred minimum and then uh you know that would be the minimum and then of course we would want it to be larger than that because you start to get once you go above the eighteen hundred and two thousand, you start to get the fourth bedroom uh in a larger unit uh above two thousand square. [1:16:18, 1:16:18]: Square feet. [1:16:20, 1:16:21]: Okay. [1:16:22, 1:16:42]: If you don't mind, I would I would uh uh venture to say you need a variety of everything. You because the different price points for the to deal with the different folks with different economic backgrounds that that can purchase I'll get to you in just a second, that uh can purchase the homes. So you need different variety of sizes and cost factors, okay? In that aspect. I would think that [1:16:42, 1:16:48]: I don't understand what he's saying, but I'm just adding to the point that we need probably do a variety of that as well. Okay. Okay. [1:16:50, 1:17:10]: Is that is that you had any more else, Mr. Ellison? So the breakdown might be let's say like you're at Jodico in a mixed use development, then uh in a mixed use development of a size uh or scope or versus a certain amount of acreage, then you would go up to the larger townhome versus uh some areas. We do want [1:17:10, 1:17:30]: As the mayor's contention is made, some areas that might be appropriate to a but I think eighteen hundred square feet is pretty reasonable, but we do in some instances we might want less than that because again, we want to have some affordable housing in the city. So it's kind of a thinking out loud moment and a record. [1:17:30, 1:17:36]: recommendation that we're following. How do I get the larger one but steal a lot the south smaller ones at some point? [1:17:37, 1:17:48]: They can come to us and ask for a variance perhaps if if we go with eighteen hundred and then there was a neighborhood that wanted to build tiny homes, then they could come to us and ask for a variance. [1:17:49, 1:18:09]: You think about that, Mayor? It sounds good. It is um something you can apply for a variance for. Right. We would set a min a minimum of eighteen hundred square feet, but if someone wanted to come in and build a specific project like a tiny home community or an affordable home community, they could ask for a variance under that category that it would be [1:18:10, 1:18:12]: Ms. Garn Garner has something to add here. [1:18:15, 1:18:35]: special use. Yeah. Okay. Spe okay, we'll use a special use. You you don't want to use a variance. You don't want to use variances because variances um they're quasi judicial. Mm-hmm. Right? And so as you treat one, treat all. Um when you do [1:18:35, 1:18:46]: a special use or a rezoning that's legislative. So it's at the discretion of the legislative body, whether they choose to, whether or not you grind it on that side of the road or this side of the road, it don't matter. Mm-hmm. [1:18:46, 1:18:56]: Um and so variances are specific criteria you have to meet. Size, shape, topography, some constraint. So in a situation where you might want and I kinda get where you're going with it. [1:18:56, 1:19:16]: where if you're more on the outer fringe of the city, bigger. Mm-hmm. Whatever. If you're more in the heart of the city, obviously where, you know, and if the road permits it, because we're not as big as we is big, but we're still not, you know, most of our areas are small or confined. [1:19:16, 1:19:17]: [4757.6, 4777.4]: Um but if they want to build something smaller, you should want that to go through the special use provision rather than a variance. So it gets heard at the planning commission, this the CMU, the community meeting, the planning commission, and then to you guys, and then you guys make a uh final determination. That's the best route to take it through. Make it a special use. [1:19:38, 1:19:47]: Absolutely. I I I'm I'm agre y'all agreeable to that. Then eighteen hundred then with the special use. That sounds good to me. But that's that's what I recommend. All right. [1:19:48, 1:19:52]: You done, sir? Okay. Ms. Barber, go ahead, please. [1:19:55, 1:20:00]: Mr Anderson, um so currently [1:20:01, 1:20:02]: The front yard set back. [1:20:03, 1:20:03]: Is what? [1:20:04, 1:20:05]: Fifty feet. Okay. [1:20:06, 1:20:17]: So this thirty feet is what you're proposing the change to be. Yes, because we've been giving out uh uh a lot of variances for thirty feet. Um the minimum yard setback. [1:20:18, 1:20:21]: It's the minimum. The minimum lot size. [1:20:22, 1:20:25]: No. It's the side yard setback. [1:20:25, 1:20:26]: Uh it's twenty feet now. [1:20:26, 1:20:27]: Okay. [1:20:30, 1:20:32]: And you're proposing to change it to ten feet. [1:20:34, 1:20:40]: Dis that's like the distance in between buildings, yes. It still would calculate out to um twenty feet. [1:20:41, 1:20:50]: There was a there was a conflict in our code that we were trying to address with that r by reducing it down to ten feet. [1:20:51, 1:21:05]: You still have each building will still have ten yards, still have its ten yard setback, side yard setback. So ten for this building and ten for the building on the right equals twenty. So currently it'll make s it makes it out to like forty. [1:21:06, 1:21:07]: The way I read. [1:21:09, 1:21:14]: There seems to be a conflict then, so the minimum side yard you're asking for [1:21:14, 1:21:15]: Tiene. [1:21:15, 1:21:16]: Yes. [1:21:17, 1:21:26]: For the minimum distance between buildings, you're proposing twenty. Twenty, yes. Ten for one building, ten for the other. So it equals twenty, yes. [1:21:27, 1:21:32]: Currently, what is um the distance between buildings? [1:21:32, 1:21:39]: Uh it comes out to like forty feet almost. Forty feet. Okay. Because of the the way it's written. [1:21:40, 1:21:52]: Okay. I really wish that there was a table that I can see how it currently is and versus what you're proposing. Okay. Um the minimum rear yard. [1:21:54, 1:21:55]: What is it currently? [1:21:56, 1:21:57]: Um [1:22:02, 1:22:03]: Just [1:22:04, 1:22:05]: Thirty feet. [1:22:06, 1:22:07]: Thirty? Yes. [1:22:11, 1:22:13]: Well it yes. [1:22:16, 1:22:36]: Okay. Um and I do agree. But it also the reason why I hesitate because it it depends on what's the adjacent zoning, like if it's industrial or commercial, then the setback increase this distance requirement increases. Gotcha. Thank you for that. I do agree with Councilman Alexander in regards to um [1:22:36, 1:22:38]: The living area. Um [1:22:39, 1:22:44]: Increasing the amount of square footage per unit. Okay. [1:22:45, 1:22:50]: Um the ones that you have on here seems pretty small. Okay. Um [1:22:51, 1:22:52]: That's all. Thank you, sir. [1:22:54, 1:22:54]: Good. [1:22:55, 1:22:56]: Yes ma'am, go ahead please. [1:22:57, 1:23:02]: If this is a continuation from last week's meeting, then I would like to go [1:23:02, 1:23:16]: I had a a development authority meeting and we talked remember we talked about the stars of the hotels? Is that the same is are we still on that same issue of diff changing different codes and different things right now? Is that what we're doing? Oh what what are you referring to exactly? Uh [1:23:17, 1:23:37]: So last meeting we talked about what star group of hotels we would want. Oh no, this doesn't it's not related to the totally different cause I was gonna say three stars is good after going to the development third retreat. This is strictly on town homes, MFR, yeah. Okay. So that's fine. I I just wanted I didn't know if it was in addition to that. [1:23:37, 1:23:39]: Yeah. No mail. All right. [1:23:40, 1:23:43]: Any other questions at all? [1:23:43, 1:23:57]: I don't have a question, just a comment. So based on um the current square footage or the front setback of currently 50 feet versus 30 feet. [1:24:01, 1:24:14]: I do support changing it to thirty feet just to accommodate multifamily units. Um but as far as the side yard and the distance between buildings, I prefer to keep those the same. Um [1:24:16, 1:24:22]: And the same with the rear yard setback. I prefer to keep it at thirty feet as opposed to the twenty feet that you are [1:24:22, 1:24:23]: Proposing. [1:24:24, 1:24:30]: Those are just my suggestions for the council to consider. Thank you, sir. All right. [1:24:30, 1:24:38]: And that makes a point on whether or not the council will consider those recommendations or not, whether or not there's approval or disapproval in that process and what was just made. [1:24:38, 1:24:41]: Anybody else any comments on that thought process? [1:24:42, 1:24:44]: Yes, sir. Go ahead please. [1:24:45, 1:25:05]: Mr. Anderson, I I asked this question uh at one of the other meetings about um the updates of the UDC and you indicated that um there are some modifications and you'll be coming before the council with that. So it it again [1:25:05, 1:25:25]: Again, I'm sorry going back to the same question because every meeting it comes before the council. So at what point in time will the UDC somewhat be updated so we would not have to, you know, pick and choose like this? [1:25:25, 1:25:45]: Facebook, Council Member Thomas, you wait for a pattern or a trend to develop. Once a pattern or a trend develops, and where we keep coming to council asking for variances or exceptions to the code, and once that trend has been identified, um then it's recommended that you update your code to reflect the code. [1:25:45, 1:26:05]: That pattern and then and then that way it would eliminate future so many future uh barrences or the need to come back before a council. So we we're we're not there yet, you know. Yes, that's why we're here with this with this MFR, because the the 50-foot front yard setback was causing a lot of issues with with developers and um causing the need. [1:26:05, 1:26:18]: For us to come before you for variances. So that's why we um decided to amend it to thirty feet. Okay. Yes, sir. And also um Quentin and I have been discussing and he'll be probably sending out some notification, but [1:26:18, 1:26:21]: Um hopefully at our upcoming retreat in the new year. [1:26:22, 1:26:28]: We wanna look at not just the zoning the UDC but also looking at the uh code of ordinance as well where we [1:26:29, 1:26:41]: need to make some changes and get some recommendations from you guys as well as from the staff. Um just talked about that yesterday. So I told him that's something we could put on the retreat for us to discuss at um at our treat next year. [1:26:42, 1:26:50]: Thank you. But but but what he's doing now is just trying to fill the potholes where uh we see them happening based on what's what the markets [1:26:50, 1:26:52]: And design is happening around the Montrealy. [1:26:53, 1:26:53]: Thank you. [1:26:56, 1:26:58]: Any other comments? Council? [1:26:59, 1:27:19]: If not, this is a public hearing. So I'll open it up uh for any comments from the audience. Uh so I'll start on my very left side. Any positive comments uh for this particular proposal? My very left, in the middle, my very right. Any negative comments from in reference to the proposal? My very left, the middle. [1:27:19, 1:27:31]: Am I right? Seeing none. So I'll close that piece of this public hearing up. So on that note, the council I need a a motion to um to approve this based on our conversation. And what would that motion be? [1:27:34, 1:27:54]: Go ahead, sir. I will make a motion to approve the staff recommendations, including the changes that we had asked for, including the eighteen hundred square foot minimum, uh with a special use permit required for anything smaller than that. [1:27:54, 1:28:12]: Staff had recommended that we have twenty feet between the new homes w to close a a conflict in the um in the current code and certainly I make a recommendation uh for that as well. Is there a second of that motion? [1:28:13, 1:28:15]: I second. Ms. McGann second, and all favor, please indicate. [1:28:17, 1:28:17]: Okay. [1:28:19, 1:28:32]: I oppose. I stated my um comments earlier what I hoped that council would consider, um considering um city council district four. [1:28:32, 1:28:52]: is one of two districts that has um upcoming developments that these this would be affecting. They chose not to consider any of the recommendations. Well council member barber um this will affect future developments. The ones that currently future developments in city council district four and five these [1:28:52, 1:29:00]: The other districts don't have any residential developments coming. Thank you. All right. On that note, the motion passed 310. Thank you. [1:29:02, 1:29:10]: What's that, sir? And I want to ask this maybe of Mr. Gardner and uh of staff. [1:29:10, 1:29:30]: Now, accordingly, Clowns can can make a motion at any time to make a change. But to make a change, we have had subsequent discussion tonight about different facilities. We have restrictions on certain facilities uh in the city. So we wanted to make a recommendation uh to incre uh to add a particular big [1:29:30, 1:29:35]: business to that distance requirement, what is the process behind that? [1:29:36, 1:29:51]: Um, we would go ahead and treat it uh because that would be a text amendment and correct me if I'm wrong under the new rules, that would entail us advertising it, putting the language together, bringing it back before the planning commission and to you guys to adopt whatever that restriction would be. [1:29:51, 1:30:11]: Well, this is what I'm going to suggest for the council. Now I'm in agreement that we these storage facilities are pervasive and they try to locate along certain areas. This is a use that really probably needs to be put a distance requirement on it. We have the dollar stores that have a five mile requirement. [1:30:11, 1:30:28]: certain businesses with so many coming to so many different areas, I would like for staff to go back and and research that text amendment to put a distance requirement between these facilities going forward equivalent to where the dollar story is about five miles. [1:30:29, 1:30:38]: Will do. Thank you. That's what I'm saying. Is there is the consensus from the council that for that? You good? Folks? [1:30:40, 1:30:41]: You have a mission. [1:30:42, 1:30:43]: Well, they'll have to create one. [1:30:46, 1:31:05]: Right, you good with that as well? I'm okay. So you get good tasking. Okay, there you go. Thank you. Appreciate it. All right, so uh out item number four is is postponed or rescheduled for another date. So we'll go to new business item number five, speed bunts speed hump installation on Maple Leaf Drive. Mr. Aaron, please. [1:31:13, 1:31:33]: Yes, Mr. Mayor. We've had uh residents of Maple Leaf Drive submit a petition for speed humps on Maple Leaf Drive. So we verified the property ownerships for those residents on that street. And everything is meets the standard. So we're just asking for counsel to approve that. [1:31:33, 1:31:35]: The installation of the speed humps. [1:31:36, 1:31:56]: Okay, we kinda go ahead, sir. Let me say this. The residents in my neighborhood, Winslow at Eagles Landing, they collected the signatures. I did not participate in collecting the signatures because I didn't want it to overly uh undo affect the results. They did. Uh Miss Bremer went around, knocked on every door uh on Maple Leaf Drive. [1:31:56, 1:32:05]: And got signatures, and trust me, the neighbors are in support of that with the speeding that's going on on Maple Leaf Drive. [1:32:06, 1:32:13]: Careful. Yes, sir, go ahead, please. Uh there, can you indicate uh which method they use as far as the number of signatures? [1:32:15, 1:32:24]: Well what what the petition requires is that you gotta have at least fifty one percent of the residents on that street that vote in the affirmative and sign the petition. [1:32:25, 1:32:30]: Okay, on the street or in the subdivision? On the streets. [1:32:31, 1:32:35]: All right. Thank you, Mayor. No, you're welcome, sir. No problem. [1:32:36, 1:32:37]: All right, please. [1:32:37, 1:32:48]: So I know that um and I do support um the speed bumps as the residents have asked for. My only point of contention is I've got residents in my district. [1:32:48, 1:32:50]: Who also [1:32:50, 1:32:54]: Did a petition, I believe, back in twenty eighteen. [1:32:54, 1:32:56]: Um on Shields Road. [1:32:57, 1:32:57]: And [1:32:58, 1:33:00]: Um based on staff [1:33:00, 1:33:10]: They said that speed bump that road is considered a secondary road and they couldn't install speed bumps. [1:33:10, 1:33:13]: So what I need to understand is [1:33:14, 1:33:17]: How staff is making the decisions [1:33:17, 1:33:19]: based on the petitions. [1:33:19, 1:33:23]: without bringing them to the council for the council to make the decision. [1:33:23, 1:33:27]: If you bring in this petition to the council to vote on [1:33:28, 1:33:48]: I don't understand why you didn't bring the one for Shields Road here to the council to make a decision. Because the ordinance says it's for residential streets. Shields Road is not a residential street. So t in fact the ordinance says it's subdivision roads. It's not major thoroughfares and secondary roads. It's [1:33:48, 1:33:56]: Says residential and Shields does not qualify for speed humps based on the ordinance. It's not a subdivision. Yes, ma'am. Thank you, sir. I appreciate that. [1:33:58, 1:34:07]: Any other questions? Yes, one. Go ahead, please. I I noticed that our next agenda item is the change of our policy for speed bumps. [1:34:08, 1:34:28]: What is the percentage of speed that goes through Winslow? Is that I'm assuming that's fifty one percent on that street. But what is the percentage of the speed going through that Winslow? Is it it does it qualify for the fifty one percent based off of what we would consider the new policy as of if w if we vote for it today? So [1:34:28, 1:34:48]: Reason why we're asking for the new the updated policy is that we've been kind of circumventing it's gotten to the point where a resident can call and say, Well, I saw somebody speeding on my street. And so then the next step is they submit a petition. And we've allowed [1:34:48, 1:34:57]: that but what I'm trying to get is a flow chart in here and that the first part of the process if they call and say, hey, we got an issue with speeding. [1:34:58, 1:35:18]: Then we do the speed study. And the speed study determines whether or not we install speed humps. If the speed study justifies that there's a need, then the next step is they go to the petition process. And then the next step is that we verify the petitions, they meet the requirement, then we follow up like we do with [1:35:18, 1:35:24]: We'll verify all the homeowners and we'll come before counsel and say they have met the requirements for speed bumps. Okay. [1:35:25, 1:35:33]: So but we don't know w what that speed is from Winslow. I mean, even though w the he they'll be grandfathered in on the on the other [1:35:33, 1:35:34]: Older. [1:35:35, 1:35:37]: Oh petition. [1:35:37, 1:35:40]: I didn't know if we did a speed check on there or not. [1:35:40, 1:35:48]: Under this policy, the revised policy, it's in the old one as well, but I just want to make sure we're following this flow chart because it says [1:35:48, 1:35:55]: The eighty-fifth percentile speed is an indicator used to determine the maximum reasonable speed by performing a traffic study. [1:35:56, 1:36:08]: If the study indicates that the 85th percentile exceeds thirty-five miles per hour, the petition process will proceed at fifty-one percent of the petition area. Right. So we'll have [1:36:09, 1:36:24]: uh scientific data to justify why we're putting speed humps in because the National Highway Safety says for every speed bump that you install, it delays an emergency response vehicle between six and fifteen seconds. [1:36:25, 1:36:25]: So [1:36:26, 1:36:46]: That's why we're we're coming to you because there are some residents that call and complain that have had like multiple back surgeries. I know one resident called me, and every time they go over those humps, that causes them an issue. So we just want to make sure when we install it in that we keep in mind that emergency response vehicles are responding in these neighborhoods and we don't want to [1:36:46, 1:36:50]: do anything that could possibly delay them responding. [1:36:50, 1:36:50]: Thank you. [1:36:51, 1:37:06]: I must have missed something, but what's the cost factor on this if we pass this? Four forty forty uh the insulation of the hump. Oh, the speed humps? Yes. It's just standard. It's it's negligible. It's included in the public works budget. We have money for signs and speed humps. [1:37:06, 1:37:26]: All right. So be it. If there are no other questions in a motion to accept this proposal. So moved. Is there a second? I second. Ms. Ganttz second that from now. Is that again all favorite, please indicate? Unanimous decision. Thank you very much, sir. Uh city uh stop rate speed hump policy update. Ms. Aaron, you were kind of talking about that before, but further explain, please. Yes, sir. We just want to make sure. [1:37:26, 1:37:46]: Sure, we're following this flow chart and we don't just arbitrarily because people call, because one person said, They're just speeding all the time in my neighborhood. Or we had a call, like somebody said, Well, somebody passed around the school bus while the stop sign was out. We need speed humps. That's not a reason to put speed humps. We just want to follow a process that we [1:37:46, 1:37:54]: We can verify that there's the actual problem in that area versus we being reactive and say, okay, well, we put put the speed humps down. So [1:37:55, 1:37:56]: Mayor. Yes, Mayor. [1:37:56, 1:38:03]: Um, thank you for that. I you kinda gave us the explanation and the other question I had, so I appreciate the presentation on that. [1:38:04, 1:38:21]: I agree that data is and you've already mentioned that it's very nominal, the cost to check on speed. So um to to keep the or get gather data based off of the speed checks. So um I would like to motion to approve the. Let me ask you a question first. Okay. [1:38:22, 1:38:29]: So I just want to understand one thing. How many speed bump applications have you received? [1:38:29, 1:38:49]: Well uh to justify okay, well we need to add this next step. So how many applications have we received? Well, we get calls all the time. I know how many applications have we received? Currently we've got I think there's eight petitions floating out there in various stages of people trying to collect signatures. [1:38:49, 1:39:00]: get it then they don't get the statistics. So how many do you have that have the the the signatures moved through and how many have you installed in the last year? [1:39:02, 1:39:04]: Let me see. I think we've done [1:39:05, 1:39:14]: two in your neighborhood. We've done some in uh what's the subdivision? We only got one in my neighborhood and that's Wimbrook. So we're we've done about five. [1:39:15, 1:39:19]: So within the last year you've done five in what subdivisions? [1:39:20, 1:39:27]: So uh we've done what's the one. One was in my subdivision two years ago, I think. [1:39:27, 1:39:30]: Um what's the one oh um? [1:39:31, 1:39:40]: The only Wild When are you saying? Wild Win, we've done Wild Wind. Um the one on I think it's Summit off Banks Road. [1:39:41, 1:39:54]: We've done a couple of in there. The homeowner associates is very adamant about having speed humps in their neighborhood. And then the other one is I I can't recall what the other one is, I don't have it with me. But we've done [1:39:56, 1:39:56]: Several. [1:39:57, 1:40:06]: The the only con c concern that I have is and I and I understand that we want the data there, but I don't wanna discourage the residents who are really [1:40:06, 1:40:10]: wanting to pursue this'cause it takes a lot of work to go out there and collect. [1:40:11, 1:40:13]: Fifty or sixty six, that's a lot of work. [1:40:13, 1:40:31]: Well, they here's the problem with it. They they don't have to do the work until you figure out the speed. Once you figure out the speed, then they know the percentage that of the signatures that they have to get. Mm-hmm. That's so the data comes first and then they know whether or not they even qualify to even get the work done. [1:40:32, 1:40:39]: And that to me is enough within itself. It's like it gives them s a little bit of ammunition. [1:40:40, 1:40:56]: But not only that, it seems reasonable. I know that some cer uh uh everybody's not blessed to have a neighborhood that has the circle roundabouts to break up the the speeding. And we still hear about speeding even in my subdivision, even though we have some of the roundabouts to break that up. [1:40:57, 1:40:58]: I think that [1:40:59, 1:41:04]: you know, things can get out of hand without the data. And we do need some type of measurement. [1:41:05, 1:41:06]: Because speed bumps [1:41:07, 1:41:08]: They [1:41:08, 1:41:10]: It can become a problem. [1:41:10, 1:41:21]: Buses go across those feed bumps, you've got the police, you've got ambulances, you've got fire trucks. And I know that it also too can be for safety measures. [1:41:21, 1:41:24]: But in addition to that, sometimes overkill. [1:41:25, 1:41:31]: And we just need to be aware of that. Like it it can definitely be overkill. And so [1:41:32, 1:41:42]: When one neighbor your hood gets at one street, then the next one won it, then the next one won it, then the next one won it. And it they may not very well qualify. They might be going thirty five miles per hour. [1:41:43, 1:41:57]: And so if they get the speed traffic things done before, then you know what the requirement is to get those speed bumps. That means that they're flying across the street. But if the study shows that they're not flying, [1:41:58, 1:42:01]: Then there's no real reason to get speed bumps. [1:42:01, 1:42:02]: 'Cause they're really not blind. [1:42:03, 1:42:08]: So they're abiding by whatever that speed is or whatever the requirement is. [1:42:08, 1:42:12]: And they don't do the work until they know the average of the speed. [1:42:13, 1:42:18]: They don't do the work first, they do the work they go get the petitions after they get the average. [1:42:18, 1:42:28]: There's a process and the play that will come in place first. Somebody provided notice. So what do they do? Okay. We're gonna go and measure speed. If they're speeding, okay. [1:42:28, 1:42:30]: Hono homeowner association president. [1:42:31, 1:42:46]: It says here, you're right, they are speeding. So now you need to go and get a petition. Or we're automatically going to provide speed bumps to you because of X, Y, and Z speed. Or, you know, so I think that it's the checks and balances instead of just taking people's word for it. [1:42:47, 1:42:52]: 'Cause then you have different streets getting speed bumps. And I just think that we need to [1:42:53, 1:43:01]: be a little bit more aware of that. I don't s I I go into subdivisions up north. We always want to compare up north. I don't see speedrums in no subdivision like that. [1:43:01, 1:43:05]: I mean it it can cause some problems, right? Um [1:43:05, 1:43:15]: You go to Eagles Landing, you might see one or two over this little hump thing when you first coming in or you going but you're not gonna see speed bumps. Not everywhere. Right, you're not. It takes away. [1:43:15, 1:43:18]: It really does. And so I think that [1:43:18, 1:43:20]: We need to be mindful of that. [1:43:21, 1:43:24]: Um and plus be mindful of our resources. [1:43:25, 1:43:26]: All right. [1:43:26, 1:43:46]: That's just my opinion. All right. Any other comments? If not, I need a motion to accept this uh city star break speed bump policy update that Mr. Aaron wants to do. So moved. Is there a second? Second.
