Council Member Thomas. [0:30:31, 0:30:38]: Thank you, Madam Clerk. I appreciate that. Uh what we have before you, Council, and the public hearing we have public hearing deferred items. Um [0:30:39, 0:30:40]: An announcement. [0:30:40, 0:30:44]: The f fallen items have been deferred and will not be presented tonight. [0:30:45, 0:30:50]: Item number five, a comprehensive plan amendment, KCP two zero two four four four four four four-ten. [0:30:50, 0:30:59]: And in this case, awaiting for the decision of the text amendment for the gas station distance requirement, which is hearing uh hearing date to be determined later. [0:30:59, 0:31:11]: Item number six, special use permit, SP-2024-01. And it's awaiting the season of the text amendment for the gas station. Once again, distance requirement, which will be scheduled at 10 of the date. [0:31:12, 0:31:32]: Item number 14, annexation case EAAX-2024-02. That deals with the SR zoning district does not state whether they need a sewer or septic. Clarification on that. [0:31:32, 0:31:44]: AX-2024-02 and the applicant is changing the site plan and is adding a commercial component to development per Councilman Alexander's request. [0:31:45, 0:32:05]: Item number 15, comprehensive plan amendment, case CP-2024-09. Once again, applicant is changing a site plan and is adding the commercial component to development per. Once again, Councilman Alexander's request. Item number 16, rezoning case RZ-2024-10. Once again, applicant is changing. [0:32:05, 0:32:10]: Changing the site plan and adding a commercial component to development per Consumer Alz Alexander's request. [0:32:10, 0:32:21]: Mayor. Yes, sir. If I could just say a brief word about that. Sure, go ahead. Certainly I encourage all the citizens to be involved and you when you see the zoning signs come up, you have an action [0:32:22, 0:32:42]: Expectation that you will be getting true transparency. Uh what actually happened was uh the plan was submitted, but the plan did not include the um commercial component that uh I had requested or that I believe would be wise for the city because I believe as we move forward in our [0:32:41, 0:33:01]: Comprehensive plan and in our planning for the city that we should make sure that we incorporate mixed-use fashion developments where residents have a close walk, bike ride, or drive to retail outlets. Actually, and folks always ask me about, you know, you put a lot of development in different areas. [0:33:01, 0:33:21]: Areas, but this development is really literally right down the street from my own home. So the same thing that I apply to you, I apply for any development that comes to the particular area. And when we finish with this and the rendition that we've asked for, uh, if you know about the Winding Creek subdivision, which is across Highway 42. [0:33:21, 0:33:41]: The homes will be very similar. Some of them will be larger, up to 3,500 square feet. And then there will be a retail component in that as well. So as uh, you know, to make your trip shorter, would it be great I talk to local residents and talk about wouldn't it be nice to have a grocer or some type of similar retail uh on that corner? [0:33:41, 0:34:01]: as well because if you've ever driven that uh corridor on Highway 42 from McDonough to Stockbridge, there's literally nothing there uh to support uh the commercial side that we uh that we need uh in the community. So be patient. Uh the plan will be resubmitted and uh it'll be the best plan. [0:34:01, 0:34:21]: And I think as Ms. Gantt said at our last meeting, when you come in Stockbridge, we're going to get excellence in everything that we do. I heard I hear those whispers out in the community that people annex to get lower standards. No, they don't. They annex to get the best, and that's what we're going to insist upon in all the development that comes our way. So thank you. [0:34:21, 0:34:22]: Thank you. [0:34:22, 0:34:27]: All right, appreciate that. Um now council in the adoption of the minutes uh the agenda, please. [0:34:28, 0:34:30]: So motion to adopt the agenda. [0:34:31, 0:34:32]: So move. Is there a second? [0:34:33, 0:34:35]: I second. Okay, Ms. Gantt second. All in favor, please indicate. [0:34:36, 0:34:51]: Thank you very much. Unanimous decisions on that. What we have is adoption of the minutes of the adoption of uh minutes from November twelfth, twenty twenty four, council meeting minutes, and also the adoption of minutes from November nineteenth, twenty twenty-four work session minutes. Is there a motion to to receive those as well? [0:34:51, 0:34:53]: So moon. Is there a second? [0:34:53, 0:34:56]: I second. Ms. Dan second dad, is all in fair, please indicate. [0:34:58, 0:35:01]: Okay, it's it's an answer season. Thank you very much. Okay. [0:35:01, 0:35:03]: Madam Clerk, do you have any public comments at all? [0:35:04, 0:35:20]: Okay. All right. Ladies and gentlemen, we had a wonderful ceremonial uh portion of our meeting, uh prior prior to the actual meeting today. Uh Delta Sigma Thena, the local alum alumni chapter, uh celebrated the twenty year anniversary of the one doing wonderful things in the community. We were able to issue a proclamation to them. [0:35:20, 0:35:40]: As well as the uh Onyx Read uh Reading Club, 30 year anniversary, to honor them and amount of reading that they do in the club. I think the sixty plus members in a large contingency from teenagers to eighty-plus year old individuals that actually read books and um use off also highlights individuals that uh pr uh actually write books. [0:35:40, 0:36:00]: books in this aspect. So fantastic for them to honor them in this aspect as well. And we also identified and and at least recognized several employees of the City of Stockbridge. [0:39:33, 0:39:42]: Comprehensive plan amendment KCP-2024-03. Yes. Uh probably located in Council District 2. [0:39:42, 0:39:58]: Um consideration of comprehensive plan amendments request a change to land uh future land use dis uh designation in a parcel S zero seven dash zero one zero zero six zero zero zero on the east side of Brush Creek. One second here. [0:40:00, 0:40:02]: Okay, so I get the right version of Let Man here? [0:40:07, 0:40:07]: Okay. [0:40:09, 0:40:15]: East side of Brush Creek, uh from its uh future current excuse me, future current [0:40:15, 0:40:35]: From its current future land use designation, low density mixed use to medium density residential, allow for a town home development. Applicant Pivotal Indust Industries Enterprises Pivotal Enterprises LLC CEO of Battle Group PC. The property is located in land lot 59, District 12, and it contains two. [0:40:35, 0:40:55]: 2.28 acres, total acres, and it's going to be presented by Mr. Anderson. Also, with that, uh let's see here. Also with that, the rezoning case, RZ 2024-03, uh property located Council District 2. Consideration uh for the rezoning question. [0:40:55, 0:41:15]: To rezone parcel S07-01006-000 on the east side of Brush Creek Court from C2 General Commercial to MFR, multiple family residentials to allow for a townhome development. Applicant Pivotal Enterprises LLC. [0:41:15, 0:41:23]: The property is located in land lot fifty-nine, district twelve, and it contains two point two eight acres. Once again, Mr. Anderson, please. [0:41:24, 0:41:26]: Uh d did you read all four, Mayor? [0:41:27, 0:41:32]: Did you read all four of the cases? Uh well what it amounts to is that the [0:41:34, 0:41:39]: It's a zone modification. Okay, so otherwise you're talking about item number nine and ten. Yes, sir. Okay. [0:41:40, 0:41:46]: Uh nine ten deals with Davis Road. That's still part of this process? I thought it was separate. [0:41:49, 0:41:54]: It's a zoning modification should be. Okay, number ten is comprehensive plan amendment, but it's for a Davis Road. [0:41:55, 0:42:04]: That would be No th there are four cases associated with this uh Brush Creek Commons Town homes. You got a comp plan, um rezoning, zoning modification. [0:42:05, 0:42:25]: To w okay. So what's the fourth one? I'll I'll read the zoning modification, no problem. Zoning modification case Z uh ZM dash two zero two four-01. Proper look once again proper located in district number two. Consideration of major zoning modification request for a parcel S07A01100000. [0:42:25, 0:42:45]: On the west side of Brush Creek Court to provide for major changes to the previously approved site plan, which was a subject of a zoning modification case ZM-2022-01 in 2022 by allowing for an expansion of the site boundaries to include parcel S07-010-002. [0:42:45, 0:43:05]: on the east side of Brush Creek Commons, which would be developed as phase two of the existing townhome development. Applicant Pivocal Enterprises, excuse me, LLC, CO Battle Group, PC, the property is located in Land Law 59, District 12, and it contains 2.28 total acres. Now that's the third one. That's it. [0:43:05, 0:43:25]: That's it. I would imagine, okay, because the other one next one deals with Davis Road. Yes, sir. All right, Mr. Anderson, uh Mr. Anderson, go ahead, please. Uh good evening. Uh this these three cases are associated with it with an item that came before city council back in November of 2022, where uh the Brush Creek Crummons Commons Town homes the [0:43:25, 0:43:35]: development plan was modified. So what the applicant is seeking tonight is basically to add a phase two and to seek to rezone property that is currently zoned C2. [0:43:38, 0:43:45]: To in total is eighteen point two acres. Um the parcel is um [0:43:49, 0:43:57]: It's fairly level, wooded, and vacant. Property access exists via a 30-foot access easement off North Henry Boulevard to Brush Street Cummings. [0:44:00, 0:44:10]: The current city zone, as May the mayor previously mentioned, is zone C2, and the applicant is seeking to uh rezone that to MFR to build 19 additional townhomes. [0:44:15, 0:44:35]: The surrounding zoning, north of the property, you have a mobile home residential and SR suburban residential. To the south, you got C2, General Commercial, MFR, multifamily residential, and SR suburban residential. To the east, you got suburban residential, and to the west you got heavy commercial. The future land use [0:44:34, 0:44:54]: Designation right now is low density, low density mixed use, and the applicant is seeking to resign, I mean to complain amendment to medium density residential. The surrounding land uses include to the north, two mobile home parks and metal ridge subdivision, to the south, commercial uses, quick trip and the waffle. [0:44:54, 0:45:11]: House and apartment community. To the east you got Metal Ridge subdivision, metal ridge subdivision and individual single family residentials. To the west you got commercial uses. Here's the aerial photo of both phase one and phase two combined of the two parcels. [0:45:15, 0:45:17]: Here's the existing future land use map. [0:45:21, 0:45:26]: And based on that, staff recommended approval for the comp plan. Now I'll move into the rezoning. [0:45:30, 0:45:50]: Uh I'm gonna give you a little background on the um zoning history. Uh originally in two thousand in July 2003, case number uh RZ-0304, the applicant rezoned from R2 single family residential to RM2, which at the time was residential multifamily townhomes. The developer installed a [0:45:50, 0:45:57]: Bush Creek Court, but did not inst uh construct any any uh buildings. There were a development agreement. [0:45:58, 0:46:15]: Plus two amendments. Rezoning included a development agreement followed by two amendments. They included various development conditions and required certain amendments to be included into development. There was a zoning modi zoning modification which was approved by council in September of 2022. [0:46:15, 0:46:19]: And the applicant has started construction on phase one. [0:46:23, 0:46:25]: The surrounding land uses [0:46:25, 0:46:45]: Like I previously mentioned, includes two mobile parks, two mobile home parks and Metal Ridge subdivision to the north. Commercial use is Quick Trip and Waffle House to the south. To the east, you got the Metal Ridge subdivision and individual single-family residence. And to the west, you got commercial uses. The surrounding zoning, to the north, you got the mobile home. [0:46:45, 0:47:05]: Park, which is zone mobile home residential, and SR suburban residential districts. To the south you got C2 General Commercial, MFR and SR Suburban Residential. To the east you got SR Suburban Residential District, and to the west you got C three, which is heavy commercial, and C2. [0:47:09, 0:47:11]: Here's the vicinity zoning map. [0:47:13, 0:47:20]: As you can see that the applicant's request is not incompatible to the rest of the vicinity. [0:47:23, 0:47:25]: Here's a zoning map, a complete zoning map. [0:47:32, 0:47:41]: Here's the phase one site plan. Also south of that is the phase two site plan, which is that which is what the applicant is proposing tonight. [0:47:44, 0:47:45]: Here's a rendering. [0:47:47, 0:47:49]: Other proposed town homes? [0:47:51, 0:47:56]: Staff recommended approval for the rezoning with [0:47:57, 0:48:12]: Around twenty f what around thirteen let me see. There are like twenty seven conditions that staff recommend approval of this zoning item. Now I'll move into the um zoning modification push. [0:48:21, 0:48:28]: Staff basically the zoning modification is similar to the rezoning, so staff basically recommend an approval with condition for the zoning modification as well. [0:48:29, 0:48:37]: And it also has twenty five zoning conditions, which I will read into the record later after the decision is made. And the applicant is here. [0:48:38, 0:48:58]: All right. Thanks, sir. So obviously now let's let's go back to the very first one, right, that you uh read in reference to the comprehensive plan amendment. All right, and um the first up. Uh so um as you mentioned that uh counselor, any questions or concerns you have about that comprehensive plan amendment? [0:48:58, 0:49:00]: Mm-hmm. [0:49:00, 0:49:00]: Yeah. [0:49:00, 0:49:02]: Yes, sir. Go ahead, please. [0:49:03, 0:49:04]: So [0:49:05, 0:49:25]: These three agenda items are in district two. I have met with the staff and had conference with uh Mrs. Battle. Um, I don't have a recommendation, uh, but I would like for Ms. Battle to make her presentation and of course uh count. [0:49:24, 0:49:30]: speak to maybe some of the conditions uh in the development side of it. [0:49:30, 0:49:32]: And I just wanna just m mention that. [0:49:32, 0:49:34]: All right. Uh Miss Battle, please. [0:49:47, 0:49:55]: I would imagine you have a presentation that you wanna present as well. Okay. Trying to get there, honey. Okay. One second. [0:49:59, 0:50:19]: Good evening, Michelle Battle with Battle Law 3562, Habersham at North Lake, Tucker, Georgia, 30084. Um, pleased to be with you all this evening with regards to this um particular project. Um as staff has indicated, um, this project has been around for quite some time. Um, to think that it was uh [0:50:19, 0:50:39]: Originally, um at least phase one was rezoned in 2003, and we still don't have units. Um but um Pivotal Enterprise has come in and taken over the project since the original developer and has proceeded with getting the final plat. So there has been work on phase one, um, but they also had a [0:50:39, 0:50:59]: Acquired this additional 2.28 acres of land and desire to add it into the overall project. I think it really makes sense when you look at the location of this property, which is behind the Waffle House, and also kind of behind across the street though. [0:50:59, 0:51:19]: Quick trip. So this property, currently zone C1, really has no visibility from North Henry Boulevard. And so that makes it very difficult for development for any type of commercial use. We believe that it was much better suited to be added in, particularly when you look at the existing layout and where uh the [0:51:19, 0:51:39]: Amenity area comes down Brush Creek. So the site plan or the aerial that you see here in front just shows where the Waffle House, the quick trip. You've got the uh life storage facility on the other side, then you've got an apartment complex that does abut um a portion of the 2.28 acres. This is the [0:51:38, 0:51:39]: Yeah. [0:51:45, 0:52:01]: designation here in the front, but the rest of Rush Creek has the MFR designation and that's what we're trying to get to. We want to be consistent and compatible in order to be able to add this property into Rush Creek. [0:52:03, 0:52:20]: So the previously approved plan is the plan that you see here. Um and again these lots have now been platted and they are ready, um I believe a close-pad ready to be able to start putting in units. And what we are again looking to do is to add [0:52:22, 0:52:25]: into that space. When we look at [0:52:25, 0:52:45]: Overall site plan, what you see is that phase one had 41 units or has 41 units. Those will be rear entry units with access from a alleyway that runs behind. So they will be again rear access. [0:52:45, 0:53:05]: Will be front entry. That is largely because of the size and shape of this lot. It is an oddly configured shot site. It really does not allow for that rear entry access around the perimeter of the property. And so what we are seeking to do is to add [0:53:05, 0:53:25]: At 20 lots to the overall project that would only bring the density up to 3.39 units per acre. So this is not a real intense use of this site. There is a lot of green space that you can see on the north side of the property as there's some streams that cross over phase one. [0:53:25, 0:53:45]: The amenity areas as a result were actually placed along the entrance. So you can see that there was to be a monument sign, a gazebo with school bus and waiting area, sports field, playground, as you're going up Brush Creek Court. So it really does make sense. [0:53:45, 0:54:05]: For the 2.28 acres to be utilized for residential use as opposed to some type of commercial use that would be directly across from those from that amenity area. So when we join in here, this also allows for this community to have more units. [0:54:05, 0:54:13]: To help maintain the overall green space area and the amenity areas for the site. [0:54:14, 0:54:34]: And I think probably even more exciting, I know that um Councilmember Elliott has placed a lot, and not to say that all of you have not, listen let's be clear, but he and I have had to go back and forth on a couple of locations um in terms of um the townhome configuration and what they look like. And I feel like this is [0:54:34, 0:54:54]: More in alignment with some of the more modern townhome look that the city has been pushing for. It has been very difficult in many locations to get the three-story model in other communities. And so I think the fact that Pivotal has come before you with not being begged or conjoled or told that they needed to go back. [0:54:54, 0:55:14]: And relook at it, but they literally came in with a plan to do the three-story units. I think they're very attractive, a modern look. I think that they would be very attractive for young folks in particular who may want to come into this area or stay in this area. And so we are really excited about the product. Phase one. [0:55:14, 0:55:34]: Phase one will also have this three-story type product as well, and they will be consistent in look and style and feel. The only difference being phase one or rear entry, phase two or front entry. But we still think it's a very attractive look and design for the site. [0:55:34, 0:55:54]: With staff. The land use and comprehensive land use plan change is necessary in order to allow us to go to the MFR designation as staff has already indicated. Again, without making these couple of changes, we won't be able to add this into phase one of the project. The conditions that staff has recommended. [0:55:54, 0:56:05]: Amended um we are um favorable with uh let me see if I can actually get those back up. [0:56:06, 0:56:26]: That's the city's presentation, so I'm going to kind of jump through here. The conditions, we've had an opportunity to review them with staff. We feel that they are appropriate for both the rezoning and the zoning modification. [0:56:26, 0:56:46]: The reason why we had to do the zoning modification. I'm just gonna kind of do my whole presentation and the reason why we have to do the zoning modification is because we want to add this in as phase two of the overall project. And there was a development agreement that was actually executed at the time of this research. [0:56:46, 0:57:06]: rezoning back in 2003 that goes with this. Um attorney Valerie Ross has been working on that development agreement. I believe that staff, um legal staff is here this evening hopefully to be able to address that issue as it was to be on the agenda this evening as well, I believe. [0:57:06, 0:57:26]: And so that may have been the reference to the to the fourth thing, but they may have decided to hold that until the next meeting. I'm not sure, so I won't go go too far into that. But the bottom line is um the conditions that we if if this gets approved, the conditions um for the zoning modification would also [0:57:26, 0:57:46]: Be instituted into the or absorbed into the development agreement. So we had to make sure that we had conditions that applied specifically to phase two, in addition to the kind of general broad conditions, which we were not seeking to do a lot of change to. One of the differences, however, that we did want to point [0:57:46, 0:58:06]: Point out is that the original development agreement had a height cap at 40. We are asking to be consistent with the new MFR requirements, which is 45. We will need that extra in order to do the three stories and to do it in the fashion that you saw on the [0:58:06, 0:58:11]: And then I believe finally [0:58:11, 0:58:31]: Um we had asked for a couple of tweaks um which staff has made. Um one was pertaining to the permit issuance. Um there had been a provision that talked about um needing a land disturbance permit and building permits, um, that those could not be issued until we recorded the final plat. Um that actually [0:58:31, 0:58:51]: Is not possible because you can't get to a final plat without getting the LDP because the LDP puts in all the infrastructure. So Counselor Ross was able to make that modification. So I think that we're set with the proposed conditions and staff will go over, I guess. [0:58:51, 0:59:00]: Guess those in more detail, but we would ask for approval of the application as proposed and conditioned by staff. Thank you. [0:59:00, 0:59:01]: All right. [0:59:01, 0:59:10]: And w one one last point. Um in terms of price points on these units, um they should be starting in about the four fifties um for um for the project. Thank you. [0:59:11, 0:59:18]: All right. Uh don't go anywhere, please. Okay. Questions, uh any questions, counsel you may have for uh for Miss Battle? [0:59:19, 0:59:22]: I was gonna defer to Councilman Thomas if he doesn't have any questions. [0:59:23, 0:59:43]: Go ahead. Go ahead. Let me just say this. Um, I'm glad 2003 never happened. I am. Because this project, I've been over there, I took the time to go over there to see it, and the three-story product is phenomenal. It is. It is price pointed at. I saw the advertisement. [0:59:42, 1:00:02]: The other day for$450, with the finished space, it could go above$500. They are exactly what you would see in a north side development. If this product was on the north side, it would be$600,000,$700,000. The the delta detail that has gone into [1:00:02, 1:00:22]: To it, eight-foot doors, nine-foot ceilings on the bottom and top level, uh, tile showers, granite, office space on the lower level, 2300 square feet. These are town homes that other developers told us wasn't possible to be built in Stockbridge, but this uh raises the bar for the [1:00:22, 1:00:42]: Level of development. I just want to make sure we're consistent. We got the paths in there, we got uh everything else that we demanded of other uh developments in themselves. But you really should did yourself a disservice not bringing a picture of the actual development because it is absolutely stunning. [1:00:42, 1:01:02]: Because again, those rear entry garages and the approach from the rear is very, very attractive. Again, you know, with 500 square feet of flex space in the basement, it could be a full fruit three stories and could go to 3,000 square feet. So these is [1:01:02, 1:01:22]: Is exactly, I think, what we've been looking for because I think we wanted to be an example of saying we wanted townhomes equivalent to what you would see in a single family home. If you walked in this town home, you would not know that you were in a townhome. You would think that you were in a single family home, and uh the [1:01:22, 1:01:42]: Level of quality that they went to just by seeing it and being in its midst, understanding. We've already approved the rear entry model. The front entry model is just as attractive as the rear entry model. And as was indicated, I do believe that this is much better. [1:01:42, 1:02:02]: better suited for this development than to have some residential come there because we've had some some commercial come there that may not be exactly what we desire. So from have from seeing it firsthand basis and the conditions that the staff has actually recommended, I I think it's um it certainly would be [1:02:02, 1:02:08]: Uh it's uh is something that uh the council should certainly consider looking at favorably. Thank you. [1:02:09, 1:02:29]: Mr. Thomas, do you have anything, sir? I just wanted to concur. One of the things that stood out for me was the uh the rear entry, because in some of the other previous development, I always questioned uh the front entries. So uh this is just one of the issues that stands out, but I do concur with uh Councilman Alexander's comment. [1:02:29, 1:02:30]: Okay. [1:02:30, 1:02:32]: Ladies, any comments over here? [1:02:32, 1:02:33]: [3753.9, 3772.3]: I just think it's a great development in general. I love it. I love the look of it. Um, I think that's something that we definitely have stated in the past. Like if we're gonna get a town home, make sure it's a nice townhome. And this is extremely nice. The design of it is desired and it's something that we see [1:02:52, 1:03:12]: in um some of the prominent areas in in Atlanta. Um and so I I love this design and I think that it will definitely attract millennials. Um I think that it's something that that we just we want it and it's the vision that we have here for our city. So [1:03:12, 1:03:14]: That made my life very difficult. [1:03:14, 1:03:25]: Yeah. Moving forward. Right one, Councilman Alexander. Okay. How many bedrooms? [1:03:30, 1:03:31]: Four or five Everons. [1:03:32, 1:03:35]: How many are four and how many are five? Just curious. [1:03:36, 1:03:44]: Yeah, sir, why don't you why don't you come to the mic? Why don't you come to the mic, please? Just come to mic. Come to mic, please, gentlemen. I'm just cueing. Just come to mic. [1:03:46, 1:04:06]: I don't think that that has been determined. Um in part probably as the um new residents uh come in they will be able to make that selection as to whether or not they want it to be a um a bedroom or if they want it to be office space. There you go. Um say your name, yeah, your address. My name is Masood Fatimi. I live at forty three twenty Peppermill Road. [1:04:06, 1:04:26]: Marietta, Georgia. But my son lives here and is the Ho Chi Bank controlling the construction. The designs are definitely definitely three bedrooms. And depending on whether the master bedroom has a sitting area. [1:04:26, 1:04:46]: Or not. That has changed to four bedrooms. And on the main level, we have an area that could be a breakfast area or breakfast room. In some models, it is a breakfast room. In some models, it can turn into an office/slash bedroom. [1:04:46, 1:05:06]: Number five. So it has its own closet, full bathroom. So we also have a full bathroom stopped in the basement in case someone wants to finish the basement. Could be the end units, they have access window to the outside, so it could be a bedroom. [1:05:06, 1:05:21]: interior units they're all could be just play area or office area or anything else the homeowner wants to improve it uh in the future. Any questions? I don't know. Yeah Ms. Barber is that answer a question for you? [1:05:21, 1:05:36]: Thank you, sir. I do have one more question. Sure. So and this is mainly for Mr. Anderson. Ms. Battle may be able to answer it too. So I know that the council approved some amendments to um our codes. [1:05:36, 1:05:38]: The front yard set bay. [1:05:38, 1:05:45]: The reason why I asked how many bedrooms this is, um, I assume that it would be a family of maybe four. [1:05:46, 1:05:51]: Five people and they may all be driving. So considering [1:05:51, 1:05:53]: The number of occupants. [1:05:54, 1:05:59]: and vehicles that they may need to park um in the driveway. [1:06:00, 1:06:06]: Are we st we approved the council approved the front yard setback? Was that twenty, twenty-five feet? [1:06:07, 1:06:10]: Uh to thirty feet. Thirty feet. Okay. Mm-hmm. [1:06:11, 1:06:31]: So with this one is this this particular development is is um regulated by a development plan and they meet the um it's regulated by the Brush Creek Development Plan, which is separate from uh the MFR standards we recently adopted. So they have a governing plan that that regulates this particular development. However, they do meet [1:06:31, 1:06:42]: meet the parking requirements. They have a double car garage, which is two parking, and then they have the driveway, which considered is two parking. So each unit will have four parking spaces. [1:06:46, 1:06:55]: And they have uh and on the on the development plan they do have guest parking on the site plan. So they they meet or exceed the the current code requirement for parking. [1:06:55, 1:06:57]: Thank you, sir. You're welcome. [1:06:57, 1:06:59]: Council, any other questions? [1:06:59, 1:07:05]: Yes. Uh go ahead please. Uh I I wanted to make sure that all of the physical [1:07:06, 1:07:26]: uh question before we get into the public hearing. And I and I just noticed something in the reading about the Homeown Association. And even though we're talking phase one and phase two, it seemed like it was a discussion uh to have different entit entities but have a combined homeone [1:07:26, 1:07:44]: It'll just be one HOA and that's why that's the whole purpose of us combining it into phase one and phase two. So there'll be one HOA and everybody will be responsible for paying um the HOA assessments to maintain all of the green areas and the common areas um and recreational areas. [1:07:44, 1:07:47]: and and and the governance of the association. [1:07:48, 1:07:53]: will be by one um board. So there'll only be one board. All right. Thank you. Thank you, Mayor. [1:07:54, 1:07:56]: Yeah, the question is council. [1:07:56, 1:08:12]: And if not, then open up the public hearing. So um let's get comments from the audience or the individuals here if they have any comments at all. So anybody is four for this particular development. All right, positive comments for. On my very left side over here, any comments four. [1:08:14, 1:08:15]: Any comments in the middle? Four. [1:08:16, 1:08:19]: Any comments from our far right side four? [1:08:20, 1:08:25]: Any comments against this particular dome, something negative per se, my far left side. [1:08:25, 1:08:38]: Any comments against? In the middle, any comments against? Before I write any comments against. No comments want for or against. I'll close out that part of the public hearing. And then uh mister Anderson, please come back. [1:08:41, 1:09:01]: All right, so um let me we're gonna start with item number seven then. Unless there are any comments directly from the council right now. If not, I'll read through which is the comprehensive plan amendment case, CP-2024-03, located in Council District 2. Consideration of comprehensive plan amendment. [1:09:01, 1:09:21]: amendment request to change the future land use designation of parcel number s0 seven zero one zero zero six zero zero zero on the east side of Brush Creek Court from its current future land use designation to low density mixed use to medium density residential to allow for a town home development. Applicant Pivot [1:09:21, 1:09:37]: Enterprises LLC CEO Battle Group PC. The property is located in Land Law 59 District 12 and contains uh two point two eight acres. All right, council on that uh is there a motion to approve this or not? [1:09:40, 1:09:45]: Yes, ma'am. Well I'm sorry. Well I I do um [1:09:46, 1:09:52]: I just spoke to Miss Battle about a certain issue. Miss Battle, you may want to come back. But it does not [1:09:53, 1:09:58]: It it does not have any bearing on the approval. I just just part of the discussion. [1:10:03, 1:10:03]: Okay. [1:10:04, 1:10:13]: Is there something you need? I believe that the question there was a question, he just wanted clarification about the access. If we can put back up the site plan just so he can see. [1:10:15, 1:10:35]: Access will be from um North Henry Boulevard. There's also a side street that comes in off um in um past the um behind the QT. Um and we believe that that is sufficient access um to allow. We're not um exceeding with the um total number of units being less than [1:10:35, 1:10:49]: We technically only need one point of entry. So you do have the entry coming off the street is public up until it gets uh actually I think it's public all the way through for Brush Creek Court. Okay. [1:10:50, 1:11:10]: You could. If there's no other questions, mayor, I do recommend approval uh for the uh consideration of the comprehensive plan amendment. We got your second. Okay, mr for Mr. Thomas and Mr. Allison, all favor, please indicate. Yeah, I'm trying to answer the decision. Thank you very much, council. Okay, item number eight. [1:11:10, 1:11:21]: rezoning case RZ dash two zero two four dash zero three probably located council district two consideration of rezoning request to rezone parcel [1:11:21, 1:11:41]: S07-01-006000 on the east side of Brush Creek Court from C2 General Commercial to MFR multiple family residential allow for a townhome development. [1:11:55, 1:11:55]: Uh [1:11:56, 1:12:00]: Uh I just want clarification. Mr. Anderson, this is where you read the conditions in. [1:12:01, 1:12:05]: Yes, sir. There are like twenty plus conditions. [1:12:09, 1:12:29]: Yeah, she did it. So I just won't read it. It's number nine or what? Number nine. Mm-hmm. Okay. I think that one could. [1:12:29, 1:12:32]: Okay. [1:12:32, 1:12:51]: So we got like 25 conditions. All right, sure. Um condition number one is the rezoning of parcel S07-01-006000 for the per proposed development of phase two shall not be approved unl unless comprehensive plan amendment case RZ twenty four-0 three is first approved. [1:15:21, 1:15:38]: Okay, number six, the front yard setback of the proposed townhome lots for phase two may be only twenty feet instead of the MRF MFR district requirements of fifty feet because the second amendment to development agreement allow front yard setback that are only eight that are only ten feet. [1:15:41, 1:15:42]: Did you finish number five, sir? [1:15:43, 1:15:45]: Yes, sir. Okay. [1:15:45, 1:15:48]: Phone number seven now, Mary. All right, go right here, please. Okay. Is that [1:17:15, 1:17:34]: The you have to submit the preliminary plan before you no land disturbance. No, let me read that again. No land disturbance LDP or building permits shall be issued for phase two until the applicant submits a copy of the new preliminary site plan for the overall Brush Creek Commons development containing both phase one and phase two to the community development department. The building department shall not issue a building permit until such time as the Director of Community Development has certified that each of the prospective phase of development sewer capacity is sufficient to accommodate the additional sewage that will be generated by the proposed development. [1:20:40, 1:20:52]: Lastly, number 26. The rezoning is subject to the property owners and developers execution of the amended development agreement, which will embody these conditions of zoning for phase two. [1:20:53, 1:20:54]: Right question. [1:20:54, 1:21:07]: Right place. Now originally we had a trail plan in phase number two, which included a trail on uh the original phase. Where is that? It was along some areas in there. [1:21:08, 1:21:08]: Yeah, still there. [1:21:09, 1:21:20]: Right. So w this incorporated those same elements as well. Yes. And the main three road, how wide is the sidewalk on the main three road? Eight feet, ten feet. [1:21:21, 1:21:25]: Uh, how wide is the sidewalk? Let me let me double check, I don't wanna tell you uh [1:21:28, 1:21:40]: Because we want the main through road to connect at some point to so that there would be um some type of connection between that trail. It's just not a trail that goes to nowhere. Yeah. [1:21:41, 1:21:43]: That trail was passive, right? [1:21:45, 1:21:45]: Yeah. [1:21:46, 1:21:50]: So the the the trail is is is I think is only um [1:21:51, 1:22:10]: It's an internal trail, it doesn't go outside the development. Right, but the main through road wanted some connection point to the main through road so residents can take it and then maybe take this their sidewalk to this trail without having to cross somebody's yard or something. So [1:22:13, 1:22:16]: Ms. Bowter, you have s you have the applicant here who wants to speak. [1:22:18, 1:22:20]: We're trying to put that back up there. [1:22:25, 1:22:25]: So we go. [1:22:28, 1:22:28]: Yeah. [1:22:31, 1:22:35]: Uh if you look to the north here, we have the trail coming through [1:22:36, 1:22:48]: on this part and it excuse my name is Iman Fatami. I live off of uh 115 TI Street here in Stockbridge. Uh so the trail actually comes and connects to the main road here. [1:22:49, 1:22:59]: and comes around through the top here. We have five wood foot sidewalks in the main section, but the the trail is all through the woodlands in the north. [1:23:00, 1:23:11]: Right. Is there a restriction or is there a ability to widen that trail to the customary eight that we've been doing in other ma and like we did at the one on um [1:23:12, 1:23:29]: Yeah. No, I'm I'm saying the trail on the trail the other trail that's going to the main trail is wider than that, right? On phase two, the the the recreational trail is how wide is it? Eight that's eight feet, eight to ten feet already, right? [1:23:32, 1:23:33]: Yeah. [1:23:33, 1:23:53]: You're talking about uh I'm just trying to be clear. We've got sidewalks um within within uh along um Brush Creek Court um that allow for walkability. The trail is really for the residents, which is a mul I think it's a mulch trail. Or did you do a nice trail? [1:23:53, 1:24:13]: Yeah, it's a natural trail. No, it was not. It was a paved trail. We asked for that in the original uh rezoning. Or was that it would need to be a paved trail, not a trailer. But you can do a paved trail when you're coming through this area in the back where you've got the stream buffers and the like. I can't imagine that. [1:24:13, 1:24:19]: that not allowed that would be uh allowed because you're within some of the stream buffer. [1:24:20, 1:24:40]: Mr. Anderson, step to the podium. That's what the requirement was in the original request, because we made these conditions and put it in there that it would be a paved trail uh along that section because it would be kind of like a, you know, along the stream, you would have a paved trail along the street. That's that's what we asked for. [1:24:40, 1:24:43]: Whatever is in the development agreement now, that's what we've been compliant. [1:24:43, 1:24:43]: Mm-hmm. [1:24:44, 1:24:53]: Yes, this is governed by the original uh two thousand three um development plan and that part wasn't affected by the uh zoning modifications. [1:24:54, 1:25:13]: So they didn't ask for a modification on that portion. What they agreed to put in was a pervious trail due to the environmental issues back there. So it would be mostly a MOAS trail uh as an amenity for the residents. It was it was not meant to connect to the um to the public trail network. And uh the original development plan did not call for that. [1:25:15, 1:25:21]: I know the original plan didn't, but when they came to us, we asked that that be included. I know I did. [1:25:22, 1:25:26]: You're trying to twenty twenty two? Twenty twenty two. Okay. I can pull that. [1:25:26, 1:25:27]: Mm. [1:25:29, 1:25:43]: But we c we we we can come back to that. But certainly the main through road, we've always insisted that we have a multi-use trail along the main through road. So a five foot sidewalk, I can't ride my bike on the five foot sidewalk. [1:25:44, 1:25:50]: No sir, I'm talking about the sidewalk in front. [1:25:50, 1:26:02]: The sidewalks are five feet. Right, but we need them wider than five feet. We need them to be able to ride a bike on the sidewalk rather than wider than the street. Now that requires a multi-use trail of six to eight feet. [1:26:05, 1:26:05]: There's just [1:26:06, 1:26:09]: There's just it's gonna kill all the front yard. [1:26:10, 1:26:30]: We talking about one we're talking about one or two feet. So we're talking about we got five right now, so we're talking about going up to a So here's what the challenge is. Mm-hmm. Phase one, which came all the way down Brush Creek, already has the sidewalk installed. So the infrastructure which was approved under the final plat. [1:26:30, 1:26:30]: Yeah. [1:26:30, 1:26:35]: has already been approved and that sidewalk has already been installed. [1:26:36, 1:26:43]: So the only uh it to the extent that there's any additional sidewalk on the side where phase two is at? [1:26:45, 1:27:05]: I I understand that, but we want the residents to be able to walk out their door and get on their bike without getting in the street. And the only way that they can do that [1:27:05, 1:27:25]: is they gotta have a six to eight foot trail in front of the house. A five foot sidewalk, no one over 13 can ride a bike on a five foot sidewalk. You can't do that. So we all we've been insisting that we have those trails be at least six to eight feet wide. We're only talking about one foot, maybe two feet, if it could be six or seven feet. [1:27:24, 1:27:38]: then bikes can be written on that. Resident can leave their house. But we don't want them to have to get in their car to go to Walmart. We want them to be able to get on their bike or get on a scooter and go over there without getting in the car. That's the whole point. [1:27:38, 1:27:58]: This this subdivision is not a a very crowded subdivision. It's only twenty units. I don't imagine uh it's gonna be so crowded anyone cannot ride a bike in five foot. If you like six foot we do six foot, but main subdivision is ordinary Let's let's let's come to [1:27:58, 1:28:05]: that solution. You can ride a bike on six feet. So I'm okay with it if you widen it another foot to six feet. [1:28:05, 1:28:19]: We do that for the new twenty f for the phase two, because phase one is already right taken care of. Right. I miss battle, you were looking to see whether or not what we approved some some time ago, is that what you're looking for? Yes. [1:28:22, 1:28:37]: And as you're looking for that, otherwise the trail network that is in the green space around the the creek bed itself, there's environmental issues that uh doesn't pro prohibit you to have a concrete service. Is that what you're saying? [1:28:37, 1:28:45]: I wanna see the c I don't w what what environmental issues present present presents uh where's the code that says that? [1:28:45, 1:28:50]: For for the trail or for the sidewalk? Yes, Sam Yes yes ma'am. [1:28:53, 1:28:54]: Yeah. [1:28:54, 1:28:58]: Oh you have in uh two thousand twenty-two. [1:28:58, 1:29:07]: Could could could you explain, sir, about environmental issues there? For the trail? Yeah, for the trail. I mean if I mean uh we have wetlands. Right. [1:29:07, 1:29:13]: We have buffer zones. Right. And per your own code they're not allowed us to do any paving. [1:29:13, 1:29:13]: Okay. [1:29:15, 1:29:16]: We just need to be natural. [1:29:16, 1:29:24]: I see. And it's based on our own code that we approved some time ago is what it amounts to. Mr Anderson, you can verify that? [1:29:25, 1:29:37]: Uh that's correct correct ma. I was trying to pull up the uh uh area photo of the area to show uh council member Alexander the issues there. Miss Holliday has the conditions that we actually required. [1:29:39, 1:29:43]: It's in there. I know it is'cause I asked for it. Going back to twenty twenty two. [1:29:50, 1:30:05]: Mayor Ford. Yes, sir. While this is taking place and I want to be sure that uh this was a part of the twenty-six conditions. Uh in order for us to approve, uh we will have to approve those twenty-six conditions. [1:30:06, 1:30:17]: So I I think it's important that we do clarify that. Yeah, no problem. I mean well the way to get clarification. Uh Miss Annister working on something and Miss Battle and Vanessa working on something else. You get clarification and make sure we're we're straight. [1:30:19, 1:30:28]: Oh just like we're not saying we'll pull up. Where's the maps? The what the what's on jump. You don't know right. [1:30:29, 1:30:33]: They agreed to it. They agreed. Oh. There you go. [1:30:34, 1:30:52]: Well you that's what we really want to do. We want to get out on handle standards. Right. [1:30:53, 1:31:09]: You're trying to go to Q public the one that is going to be. They make reference to something happened in twenty twenty two, but we're gonna see. But Elton wanna insist that uh you know it's one. I don't think so. Yeah. [1:31:10, 1:31:14]: And you know what we're talking about before. Nobody outside walks along the front each other. [1:31:15, 1:31:25]: The front front hand has creep coming. Exactly. What the development plan was. I don't remember that can demand it though. [1:31:27, 1:31:29]: One five seven Brush Creek Cummings. [1:31:39, 1:31:42]: Yeah, I ain't got no room to it to expand the sidewalks. [1:31:45, 1:31:51]: They'd be up for a one foot section next to a five foot section, it's gonna work. I mean, you know what I mean. [1:31:53, 1:32:01]: No, you wanna pull up the the map? We'll show a area photo of Quick Trip in uh in Waffle House. [1:32:01, 1:32:03]: Show the area leading down there to the rope. [1:32:12, 1:32:25]: Along the frontage, there there's really no room, right? I'm saying along the frontage on Brush Creek Commons. Where you front on Brush Creek Commons Where you front at on Brush Creek Commons, do you have any room? [1:32:29, 1:32:33]: That's the So you can you can pour it in on the phase two you can pour wider sidewalks. [1:32:35, 1:32:36]: There's [1:32:36, 1:32:46]: So that's the they can that's that's the parcel right there. That's that's um Waffle House and that's the QT. And that's where they're that's where they're building over there. [1:32:50, 1:32:52]: I don't know if you want to show the phone. Sure, show it, show it. [1:32:53, 1:32:55]: You want to show that no, just show uh [1:32:57, 1:32:58]: Show that is [1:32:58, 1:33:00]: So with Buscrey Commons that [1:33:01, 1:33:02]: That's breastfree commons right there. [1:33:02, 1:33:08]: Way the development right there. Yeah, that's where they're trying to build right there, that little triangle property right there. [1:33:13, 1:33:20]: Do you have something, Mr. Ad? Uh yeah, uh the applicant is willing to uh expand the sidewalks on phase two. [1:33:21, 1:33:24]: But uh phase one is governed by [1:33:25, 1:33:31]: The original development plan that goes back to two thousand and three, when they came in and did the modification. [1:33:31, 1:33:37]: Um, they didn't seek to amend the sidewalk portion. [1:33:37, 1:33:47]: That's two thousand and three, you said. So none of us back in two thousand and twenty two or twenty two. Well they came in to amend the two thousand and three original development plan. Okay. [1:33:47, 1:34:00]: And they didn't and they did not request a modification of the sidewalks at that time. We we do we you said we d excuse me a second. So we did not. We didn't read the applicant did not request that. Did not request that. [1:34:00, 1:34:05]: But we did. And and uh w do we have the conditions from twenty twenty two? [1:34:09, 1:34:12]: All of those things were agreed upon right there at the podium. [1:34:13, 1:34:16]: They were said that it would be expensive, but we would do it. [1:34:18, 1:34:38]: Here's what I know. Whatever the conditions say, that's what we have to do. So if the condition says what you say it says, then staff can review that and just verify if that's what it said. Right now we can't the the two ordinance the ordinance that she's got there does not [1:34:38, 1:34:58]: have the actual conditions that I can see on there but the bottom line is that's easy enough to obtain and so to the extent that that's what you all approved the last time this the the final plat should be consistent with whatever you approve. [1:34:58, 1:34:58]: True. [1:34:58, 1:35:01]: So if it said six feet [1:35:01, 1:35:03]: then they should be six feet. [1:35:03, 1:35:23]: And if they have to change it, then that's i it is what it is because we have to comply with whatever you all approved in twenty one. I just want to make sure you want to say in phase two we can get the sidewalk walking while we're agreeable to widen the sidewalk to six phase two, yes. We're gonna go back and look at what the conditions were that we asked for on twenty twenty two about the pay about [1:35:23, 1:35:29]: About the uh about the recreational trail. Yes, sir. All right, thank you. Yes. [1:35:30, 1:35:37]: Okay, she found it. All right. So on that note then she says she found it. Let's see what she found. [1:35:49, 1:35:50]: Right. [1:35:55, 1:36:11]: neighboring lots, extended sidewalk to internet neighborhood development commercial space. There's nothing here that I see to be looking at me that says a specific width. [1:36:12, 1:36:28]: Those are the conditions. That's what was put forth in the um approval, both assigned by Mayor Ford and um attested by um City and the City. [1:36:31, 1:36:33]: No specific [1:36:53, 1:36:54]: Yeah. [1:37:00, 1:37:05]: I think staff just has to go back through and look at that to verify that whatever [1:37:09, 1:37:29]: Okay, this is what I would add. I'm gonna ask staff to go back and watch the actual video from that meeting and the rezoning so you can see what actually said. Sometimes staff looks and takes the notes but does not take the notes on exactly what happened. I think we should go back and watch the video. [1:37:28, 1:37:42]: as well. So certainly I'm agreeable to the sidewalls being six feet on phase two. You will go back, you will review the video and the documentation to determine what was appropriate for the recreational trio. [1:37:42, 1:38:02]: Commissioner Alexander, I think uh you may have mistaken the sidewalk with the trail. I believe I remember you discussing the trail being widened. Not the sidewalk, but we can check on that. Yeah, with a second. So on that note, the rest of the council, are you agreeable to what has been stated thus far? You all agreeable? Okay. [1:38:02, 1:38:07]: Looks like g sort of guess a consensus today. All right. So on that note [1:38:07, 1:38:17]: Mr. Thomas, are you ready to make a motion, sir? I do have um a question there for it. Okay, go ahead, please. Um I see that there is a clubhouse, but I don't see a pool. [1:38:18, 1:38:24]: I'm sure that's another thing that we didn't include. Uh th there's no pull. [1:38:24, 1:38:28]: There's no pool. There's no pool. Okay. Are we able to add a pool? [1:38:29, 1:38:49]: Um no because it's too small of a community. Um that would add too much cost. That's why the amenity area is it's going down Brush Creek. And so that was the amenities that had had been agreed to and we have not asked for any changes. Um those were in phase um one. So phase two is just to add those additional [1:38:49, 1:38:57]: Lots, but the all of the recreational area was a part of the phase one requirements. And there was no pool requirement. [1:38:57, 1:39:10]: Okay. So because we are making these modifications, we're unable to modify anything I would say this. I I understand what your request is and what I'm telling you is the applicant can't do the pull. [1:39:10, 1:39:24]: So you can make the motion, I guess, and I guess if everybody agreed with it, but we would we won't agree to the pool because the pool would put too much additional cost on a very small group of people to maintain that pool. [1:39:24, 1:39:44]: Thank you. Mr. Anderson, um are we able to make any modifications to the first phase if the council so desires to do that? Yes, if the council s so desires, but originally in um November of uh 2022, the applicant came came before council and council removed the [1:39:44, 1:39:56]: pool requirement from the original development plan. That was part of the f the phase one zoning modification that happened in November of twenty twenty two. So they removed it because of the expense. [1:39:58, 1:40:09]: Can you repeat yourself, please? Sorry, some chatter getting here. In November of twenty twenty-two, these applicants came before city council requesting a zoning modification to the original development plan. [1:40:09, 1:40:11]: That was adopted in twenty twenty three. [1:40:11, 1:40:12]: In two thousand and three. [1:40:13, 1:40:14]: They came in in twenty twenty two. [1:40:15, 1:40:17]: Requesting a modification to the two thousand and three [1:40:18, 1:40:23]: original development plan and council agreed to allow them to remove the pool requirement. [1:40:24, 1:40:33]: Because it was such a small community and a swimming pool would've made it too expensive for the HOA. So we removed the pool requirement back in twenty twenty two. [1:40:33, 1:40:40]: Thank you, sir, for that explanation. Um, but now that we are considering this second phase. [1:40:40, 1:40:42]: Then just for me. [1:40:42, 1:40:45]: I'm only speaking for me. Um [1:40:46, 1:40:51]: I think it would be a good attractive amenity to have a pool all new. [1:40:51, 1:40:55]: Developments should include a pool, but that's just me. [1:40:56, 1:40:57]: I have one other question though. [1:40:57, 1:41:00]: Reading um the staff's recommendation [1:41:01, 1:41:02]: Item G [1:41:03, 1:41:05]: It talks about um [1:41:05, 1:41:07]: The installation of treatment [1:41:08, 1:41:09]: Street trees. [1:41:10, 1:41:18]: And it says it should be installed along all streets to be placed between the sidewalk and the front property lines. [1:41:18, 1:41:19]: Mm-hmm. [1:41:20, 1:41:26]: I think we talked about this once before in another case. Um those trees and maybe I'm [1:41:27, 1:41:28]: Just [1:41:28, 1:41:31]: picturing it differently. Trees installed. [1:41:32, 1:41:35]: In between the sidewalks it's gonna make the sidewalks buckle. [1:41:37, 1:41:38]: Co it could [1:41:40, 1:41:41]: Um [1:41:42, 1:41:45]: I mean, there have been cases of that, but uh [1:41:48, 1:42:08]: I think they put a th there's some type of cage or something. N not exactly a cage that they that they can find the s the the street tree roots in, which prevents them from spreading now. So but um there's no guarantee that they won't spread, but it will be rare. So there's a new technology they use when they plant this tree. [1:42:08, 1:42:16]: They encase them inside a cage so they can't spread, the roots can't spread out and buckle the sidewalk. [1:42:16, 1:42:19]: That's that's what they use now when they uh plant street trees. [1:42:20, 1:42:35]: Okay, Mr. Gardner, help me out. Um, because I've seen I've driven through many neighborhoods and I've seen where the roots of those trees buckle and the sidewalks just tear apart. Um and of course that would be a cost to the city. [1:42:36, 1:42:39]: to have to repair those. So I want to make sure we get it right from the beginning. [1:42:40, 1:42:44]: Yes, ma'am. So it depends on the type of the species of trees they use. [1:42:44, 1:42:53]: So certain trees, um, their roots don't spread, they go down. Um, and we always advise, and that's one of the issues that [1:42:53, 1:42:58]: some development like Monarch Village Hove because they use the wrong species trees when they put'em in. [1:42:59, 1:42:59]: Um [1:43:00, 1:43:20]: And so it just depends on what species tree they use. But if you if they're gonna put'em at the back of the sidewalk on the private property, uh, as long as they agree to put it out well, utilities meant um between the sidewalk and the front property like that. Between the sidewalk and [1:43:20, 1:43:30]: It's gonna be in the middle of the yard, you know that you away out of on the sidewalk and to the house or around the [1:43:30, 1:43:38]: Can we um amend that description here so we're just specific about where to plant those trees? [1:43:39, 1:43:44]: So we can go to the water. There's no other place it can go. We can we can put in writing. [1:43:46, 1:44:06]: So it's not it's not curved, then landscape strip, tree, and then sidewalk. It's curved side I think it's a landscape piece of grass, then there's the sidewalk and then the trees are on the back side. They're not on the front side between the curb and the sidewalk. So they're not between. [1:44:06, 1:44:26]: Between the curb and the sidewalk. They're they're where the concern comes from. They're technically gonna be along the prop along the front yard, which is the best place for them to be. We don't want them between the sidewalk and the curb because then you're gonna have the issue of it bursting the sidewalk and the curbing and getting into the streets. And that's where you see those humps in the road when folks [1:44:26, 1:44:42]: 'Cause the roots are going under. Um and we could actually uh ask them to put a certain type of tree in if they don't we'll we'll name the spec the species of tree that roots go down that they can put in um that would allow for the to stop that from potentially happening. [1:44:43, 1:44:46]: Okay, I just I just wanted to make sure I addressed that. [1:44:47, 1:44:49]: Got some clarity. Thank you, sir. [1:44:49, 1:44:51]: Ms. Canton, you had a question? [1:44:51, 1:44:58]: Well, n now that sh that's been answered, I think that's a valid point in regards to the trees. We do want to be careful not to [1:44:58, 1:44:59]: Um [1:44:59, 1:45:03]: I have that experience. I think we all have it. We live in modern villages. [1:45:04, 1:45:11]: Um, you know, pi we have some oak trees, we have some trees and it does do a lot of damage to the home, pipes or you name it [1:45:11, 1:45:13]: Coming up towards the house. [1:45:13, 1:45:18]: Um and so if we can make sure that that's under control, that'd be great. [1:45:20, 1:45:20]: Okay. [1:45:20, 1:45:29]: Mr. Thomas, back to you, sir. Well, I just want to make sure about the conditions. This discussion about the trees, are they part of the conditions? [1:45:30, 1:45:31]: Yes. [1:45:31, 1:45:50]: That's already in um condition number fifteen that the owner shall install streets trees along streets to be placed between the sidewalk and the front property line. So that is on the other side. It's not like I said, there's curb, then there's sidewalk, and then there's the property line. It's between the sidewalk and the property line. [1:45:51, 1:45:53]: So yes, that's there. [1:45:53, 1:46:13]: Well, Mayor, if if that is the case, with the approval of the twenty-six conditions, I recommend that we approve the rezoning case, RZ two zero two four-03, to allow for um a rezoning from C2. [1:46:13, 1:46:33]: General commercial to MFR to allow for a uh townhome division, subdivision. And the amendment to number 27, which is phase two, would have six-foot sidewalks, and the staff is gonna go back and review the conditions for the trail network on what. [1:46:33, 1:46:34]: [6395.4, 6408.5]: That's fine. Uh Mr. Thomas, are you agreeable with that certain emotion? To include uh that conversation as well. Second. Okay. Ms. Mr. Alessandra, second that. Ms. Barber, you have a comment? Yes. Flat cameras. [1:46:50, 1:47:04]: Block cameras. Is not is that not included in your condition? I know that we thought we updated it in a in new ULDC. Can I speak without you interrupting me? How about excuse me? [1:47:06, 1:47:13]: Why is it every time I open my mouth you wanna chime in? L excuse me. Okay move forward. [1:47:13, 1:47:20]: Your way of agreeing with what I'm saying. You agreeing with what I'm saying. Again. [1:47:21, 1:47:39]: Yes, we can add that. Yes. We can add that as condition number twenty s twenty eight. Yeah. Mr. Your question uh uh this this development was on the works before we adopted our new uh standards. Okay. So it's not applicable, yes. Okay. Thanks. [1:47:40, 1:47:51]: Back to you, Mr. Thompson. So Mayor Ford, uh amend my motion to include twenty-eight conditions as stated uh in the record. Second. [1:47:51, 1:47:52]: Okay. [1:47:53, 1:48:04]: All right, all favor of the motion, please indicate. Unanimous decision. Thank you very much. Appreciate it. On that note, now we go on to the zoning modification case, ZM dash two zero [1:48:05, 1:48:08]: Two four dash zero one, probably located in district two. [1:48:09, 1:48:29]: Consideration of major zoning modification request for parcel S zero seven A zero one one zero zero zero zero zero on the west side of Brush Creek Court to provide for major changes in previously approved site plan, which is subject to the zoning modification case ZM-2022-01 in [1:48:29, 1:48:49]: In 2022, by allowing for expansion of the site boundaries to include parcel S07-010-060-00 on the east side of Brush Creek Creek Cummings, which will be developed as phase two of the zisting townhome development applicant pivotal and [1:48:48, 1:48:59]: Enterprises LLC, CO Battle Battle Law, PC, the property located in Landlaw fifty nine, district twelve, contains two point two eight total acres. Okay. [1:48:59, 1:49:04]: Mayor Steph recommended approval on that one with the same exact conditions that I just read into the record. [1:49:04, 1:49:05]: Okay, good deal. [1:49:06, 1:49:09]: Uh on that note, thank you, Mr. Ryan. On note Mr Thomas, you have a motion, sir. [1:49:11, 1:49:26]: Um are they in the discussions, Mayor? Well I well I I he said the exact same he has said the cond these conditions for this will be the exact same as the previous one. So I'm assuming that we're you know, since we agreed in the previous other twenty eight, I'm assuming that's all right. That's my assumption. That's why I just went straight to you, sir. [1:49:27, 1:49:32]: Therefore, mayor, I do move that we accept the zoning modification. [1:49:33, 1:49:37]: to include uh as stated for the record. [1:49:37, 1:49:46]: uh to allow a change, a major change to the previous approved site plan. Um [1:49:47, 1:49:56]: That would allow the expansion of this site boundaries to include parcels um SO seven. [1:49:57, 1:50:06]: Second. Okay. Major's made with the second. All favor, please indicate. Genamis decision. Thank you very much. All right. Thank you. Thank you, gentlemen. Appreciate you. Thank you. [1:50:08, 1:50:11]: Okay. Building 5 will include 4,350 square feet with [1:58:10, 1:58:30]: and 29 units and building six will mirror building three with 5,400 square feet and 27 units. Building seven will be one of the largest structures. It would encompass over 10,800 square 10,800 square feet and 48 units. And building eight will again match building three and six. [1:58:30, 1:58:50]: Offering 5,400 square feet and 27 units. The project will feature a dedicated turning lane, a storm water pond, landscaping, post-construction. 18 wheelers will also be prohibited on the property, so no 18 wheels can deliver there. Security measures will include a 24-hour video surveillance. [1:58:50, 1:58:59]: Individual unit alarms, access systems, and perimeter security cameras. Here's another site plan. [1:59:04, 1:59:08]: And this is a rendering of the of the proposed development. [1:59:14, 1:59:17]: And as you can see, the m the building materials were comprised of a brick. [1:59:20, 1:59:24]: On the north elevation, south elevation would be brick also. [1:59:28, 1:59:38]: Uh proposed self-storage warehouse development information. I've already went over this. Um of the eight buildings I listed the um I described the the square footage of each. [1:59:40, 1:59:55]: Here's a map of the existing and proposed storage facilities in the city of Stockbridge. Right now we have eight existing and proposed facilities. The star is the um, it's the proposed, is the [1:59:56, 2:00:06]: It's the s subject property that's in question tonight. And over to the left you have the one that's that was discussed at last city council meeting. [2:00:09, 2:00:10]: That shows the relationship between the two. [2:00:12, 2:00:24]: Ca question for you though. Yes, sir. Uh I sh probably should know this, but does the do we have a distance requirements uh for this? No, sir. We don't we don't have a distance requirement for self storage facilities. No. All right. [2:00:24, 2:00:28]: They're restricted in the PMU though, the Parkway Misuse Overlay District. Okay. [2:00:30, 2:00:33]: So we have a self-storage facility at um [2:00:34, 2:00:36]: being proposed that well the one in question tonight [2:00:44, 2:00:45]: We got one on North Henry. [2:00:47, 2:01:07]: 44 North Henry, 53, 34 North Henry. We got the extra space storage at 59 Banks Road. Excuse me. We have the secure self-storage at 59, at 599 Georgia Highway 138. We got the extra space storage at 1461 Hudson Bridge Road. [2:01:07, 2:01:27]: We got storage extra and 490 Eagles Landing Parkway. And we have the Davis Road storage facility at 12 Old Atlanta Road. And we have Jewel Sanitary Pad Warehouse at 1090 Village Business Parkway. As you can see, we don't have many self-storage facilities for. [2:01:27, 2:01:28]: [7296.4, 7305.0]: So as it relates to the uh the comprehensive plan amendment, staff recommends uh approval of the comprehensive plan change. [2:01:49, 2:01:50]: Mm. [2:01:53, 2:01:55]: Now I'm about to go into the rezoning portion. [2:01:58, 2:02:02]: Yeah, yeah, of course. [2:02:02, 2:02:08]: I do have a question before you move on, sir. Yes sir. Yes, sir. Mayor. Go right here, sir, please. [2:02:10, 2:02:18]: Um I n uh I know this agenda item is a request for a um [2:02:20, 2:02:28]: Land use chain designation. What what is it? What is the land use plan presently? [2:02:29, 2:02:30]: So let me go back. [2:02:36, 2:02:47]: Uh this agenda item is is calling for a land use change or what it what is it presently uh the the application is a land use plan presently. [2:02:48, 2:03:05]: Yes, sir. The applicant is requesting um a change because he has a split land use designation for the four properties. All of them don't have the same land use designation. So he's requesting to go from low density mixed use for the purpose of allowing for the construction of a self-storage. [2:03:11, 2:03:31]: Currently, the uh 649, 657, and 681 Davis Road has the future land use designation of medium density residential, which is not thank you, which is not compatible with the requested C3 zoning district. Therefore, the applicant is requesting a change to the future land use designation from the current split future land use. [2:03:31, 2:03:34]: Use to low density mixed use. [2:03:36, 2:03:45]: So the current um land use does not allow for him to construct a self-storage facility in C three because it's incompatible. [2:03:49, 2:04:00]: What what I was trying to visualize in in my understanding when y I guess a few years ago, when we [2:04:02, 2:04:07]: put the work in to designate the use of [2:04:09, 2:04:16]: Postles, you know, throughout the city. And uh you know you and I have had a conversation about [2:04:17, 2:04:37]: You know, we're we're constantly changing, constantly changing. And I know at some point in time you mentioned that we would look at our um plan to conform with the future where where we're we're trying to go. So I was trying to get a better understanding. [2:04:37, 2:04:52]: standing in in this particular area where the Walmart is, I would tr just really just trying to visualize the future of where this city and where this council really wanted to go. [2:04:52, 2:05:00]: And I know once you create uh a development like this and then it is [2:05:01, 2:05:18]: you know, you sort of create a designation and you can't really get away from that. So and I and I spoke with the with the gentleman and um and I expressed to them that I had some concern but but I wanted to hear the total presentation today though. [2:05:19, 2:05:39]: So with that being said, Mayor, I I yield back. So right now uh the the property zone medium density residential, which allows for residential uses. It does not allow for any type of commercial uses. Uh I think this designation has been um upon the property since it was annexed into the to the city back. [2:05:39, 2:05:44]: back in uh early two thousands. So it has not been changed, however uh [2:05:44, 2:06:01]: the development patterns of the area i area is starting to become more commercial on that part of Davis Road and uh down by Walmart. So it's starting to change. So it wouldn't be out of the question to seek a change in the land use to low density mix use. [2:06:02, 2:06:15]: Well I I will say that when you and I met and discussed this, uh you somewhat spoke favorable of the trend of what the city [2:06:16, 2:06:36]: what direction the city may want to go in in this particular area. And and I understood that and and I was open to that. And and I and I guess as we discuss this, other council members, and they come forward, uh it it it may become a little clearer. Yes, sir. Thank you, Mayor. [2:06:36, 2:06:36]: Yeah. [2:06:39, 2:06:40]: Oh of course. [2:06:40, 2:06:45]: Okay, go ahead, please. So what does the future land use map show for this d this property? [2:06:50, 2:06:55]: Um we just did a lot of work, right? Yes. As Councilman Thomas indicated. [2:06:58, 2:07:00]: Future Land Youth shows. [2:07:01, 2:07:13]: Low density residential for one parcel and it shows um medium density residential for another for for two other parcels and then the fourth it shows low density mixed use. [2:07:14, 2:07:16]: So it has split the four parcels. [2:07:17, 2:07:27]: has split land use designations. So he's trying to get'em up to be com the intent will be to combine uh the four parcels into one and to have one designated land use. [2:07:28, 2:07:48]: Yeah, I and I certainly understand the trends in the area and certainly uh you know, we just reviewed another um self-storage, basically a block away, and then there's one already existing that's a block away that uh along North Henry Boulevard in the same general area. [2:07:48, 2:08:08]: And I think we had expressed a desire on this council that we want something better than that. Yet we keep getting the same requests that come before us for the same or similar development that we were expecting in the area, but we continue to get the same type of request. And these uh developments [2:08:08, 2:08:27]: uh seem to continue to come before us where we're um looking at different s distinctions and I think the council did show some reservation and said that we wanted to staff to look at a distance requirement because of uh the number of these were that were coming forward. And you would be working on that, is that correct? [2:08:27, 2:08:42]: Yes, sir. We'll we're looking at that. That's on our on our list of things to do. So we will be looking at that. Uh coming up real soon. Um we haven't reached we haven't been able to do it yet, but it's on the list of items we have to do. So [2:08:42, 2:09:00]: Right, but currently this shows for medium density residential and low density residential, and this is asking for a commercial trend along Davis Parkway. Davidson Parkway right now. What else commercial is along Davidson Parkway right now? Um [2:09:02, 2:09:07]: I don't believe there's anything over there alone on Davis but uh in the vicinity. [2:09:08, 2:09:28]: Correct. So this would certainly be a tremendous change because right now there's nothing along Davidson Parkway and we just approved the development for a builder to build a number of homes uh in that area to um for approval. So um you know that the th this would [2:09:28, 2:09:48]: would be a major change because those residents have been over there and they've had drivetime automotive, which is right behind their neighborhood, driving right through the middle of their neighborhood. And I honestly I just don't see what uh a lot of value being brought in for this particular um proposal, but certainly I'll listen. [2:09:47, 2:09:48]: Thank you. [2:09:49, 2:10:02]: Council, any specific questions for Mr. Yeah, go ahead, Fitz. I I wanna make a distinction for for Councilman. Uh this is not Davison Parkway. Right. This is Davis Road. [2:10:03, 2:10:06]: So w this is a totally different area. [2:10:09, 2:10:29]: What what what what is a l what commercial right there is in that general area for so so when I get Walmart? I'm saying in terms of when I get it into the um into the um rezoning portion, I'll pull up the zoning map so you can see the uh the zoning uses over there. So I'll do that. [2:10:29, 2:10:36]: the other one that's already been considered. Okay, I mentioned it previously. Let me go back to it. Um [2:10:36, 2:10:38]: Mm mm, it's a different one. [2:10:38, 2:10:47]: You see this you see my uh cursor? Right. Got it. Okay. That's that's that's this proposed facility right here. And right here to the left. [2:10:49, 2:10:53]: That's the one that's currently on the in the development phase. [2:10:54, 2:10:59]: That's about uh legend. I uh it's probably [2:11:00, 2:11:04]: I can't I s it's it's a little more than a block. [2:11:07, 2:11:10]: No s no ma'am, this is a different group. [2:11:11, 2:11:28]: It's a different group. The other one was they had the right to uh build us a self storage facility. They had the zoning in place already. Uh this one right here that's under question that's in that we're presenting tonight, they need the zoning to build what they're proposing. [2:11:30, 2:11:36]: Yes, sir, go ahead, please. And and and as I express to to the gentleman, [2:11:36, 2:11:39]: See, my major concern with [2:11:40, 2:11:43]: Um future planning. [2:11:44, 2:11:47]: Future land use planning. [2:11:48, 2:11:52]: I want us to be conscious of [2:11:53, 2:11:54]: The future. [2:11:55, 2:11:58]: When you look at a particular area [2:11:59, 2:12:01]: What do we want to see? [2:12:02, 2:12:11]: In this area in the future. We know we have the Walmart here, and you have some other commercial. You do have some residential. [2:12:12, 2:12:14]: Uh structure somewhat in the back. [2:12:15, 2:12:23]: Uh, and I've been trying to work with some of those property owners in the past. But I I just want the gentleman to understand, too, that [2:12:24, 2:12:31]: We as elected officials and we have a planning department and things that we have to approve. [2:12:32, 2:12:47]: And I want us to take in consideration when we look at future land use, you know, what where we're trying to go, what is the future of this particular area? And and and you know, sometimes we get it right, sometimes we don't. [2:12:48, 2:13:01]: But this is why I'm sort of speaking to this point because I want us to really understand that, you know, we are at this point now where we have a decision to make for this total area because [2:13:02, 2:13:05]: Once you build whatever you build [2:13:06, 2:13:10]: That's somewhat dictates what's to follow. [2:13:11, 2:13:21]: And and you know, and if this council wanna go that way, I I I mean I'm not gonna object to it but I just want us to be conscious of [2:13:22, 2:13:23]: Future. [2:13:24, 2:13:44]: And where we're trying to go in this particular area. So what usually precipitate the um the construction of or the proposed location of these um self-storage facilities is due to the high number of construction, high number of units we have approved in the city and plus they're not building homes as large as they used to used to. [2:13:44, 2:14:04]: And uh this is uh a low intensity use, low intensity land use which has very low traffic. And it's in w we have construction slated off Davis Road and Valley Hill Road, and we have a lot of units being built off uh Reeves Creek near David and Davidson Parkway. Mm-hmm. Due to the sheer number of [2:14:04, 2:14:13]: Units we we have proposed, these types of uh developments usually pop up because of the number of units we're developing in the city of Stockbridge. [2:14:13, 2:14:14]: Okay. [2:14:15, 2:14:24]: Well maybe I I just like just hear from some of the other council members, but Okay. I I'm I'm okay with you know the decision of the council. Okay. Okay. [2:14:24, 2:14:26]: Thus far. Any other questions right now from Ms. Annson? [2:14:27, 2:14:38]: I don't have a question, it's more of a statement. So the other um public storage facility that we discussed at the last meeting, that was in my district. Yes. Um [2:14:40, 2:14:57]: This area, um, I know it's split between myself and Councilman Thomas. Um what the residents desire in the area is not another public storage facility. They want other options. Commercial. Commercial land use designation is what I prefer. [2:14:58, 2:15:03]: for this area um not including another storage. [2:15:04, 2:15:07]: It just so [2:15:08, 2:15:17]: Um urban planning is not my thing. I don't know much about it. But I would just think that we would be looking in terms of making sure that we have diverse um [2:15:18, 2:15:25]: business options and that they're not all um restricted to certain districts or certain areas. [2:15:25, 2:15:32]: We know that um a public storage facility is already coming right there on the corner of Davis Road. [2:15:34, 2:15:40]: А час канат супов анатопуль сторжі і сам vicinity a block away. [2:15:41, 2:15:43]: I think we need to [2:15:44, 2:15:46]: Um make sure that we [2:15:46, 2:15:52]: change our uh what is it the restrictions, making sure that [2:15:52, 2:16:12]: We don't have certain businesses all within the same mile radius and public for s public storage facilities need to be added to that list. Okay. Um I get it. I get it. We've got new residential developments that's popping up all over the city, but it just seems [2:16:12, 2:16:13]: Seems like [2:16:13, 2:16:19]: A lot of these residential developments are coming to my district. [2:16:20, 2:16:24]: I don't want to have a district of four or five storage facilities. [2:16:25, 2:16:25]: Um [2:16:26, 2:16:31]: And I get it. I know that with these public storage facilities they're [2:16:31, 2:16:33]: Low um [2:16:34, 2:16:43]: Low usage, not a whole lot of traffic. Um, they're pretty safe. Um, I get it. Um right now there's nothing there. [2:16:43, 2:16:44]: Um [2:16:45, 2:16:49]: Акети, базиденцово преfer то си а ресторан. [2:16:50, 2:16:52]: They prefer to see another [2:16:52, 2:16:53]: You know [2:16:53, 2:16:54]: Shopping. [2:16:54, 2:16:56]: A retail store. [2:16:56, 2:16:57]: That's what they would prefer to see. [2:16:58, 2:17:01]: Um it is close to Walmart. [2:17:01, 2:17:03]: So there are other [2:17:03, 2:17:23]: options um that we could seek. But another storage facility in the same vicinity that was well that is already being approved, I can't support it. Not at this time. Thank you. Okay. On that note, Ms. Anson, you have uh rezoning cases still go through that that particular piece too as well. [2:17:23, 2:17:41]: Yes, yes sir. The rezoning will come after the after I announced what staff recommended for this. Well staff well staff recommended approval for uh the the land use change from medium density residential to low density mixed use. [2:17:42, 2:17:47]: For the construction of this facility. All right. So staff recommended approval. All right. [2:17:47, 2:17:50]: So I I'll move on to the uh reason only. Okay. [2:18:13, 2:18:33]: In our analysis, after we researched and objectively evaluated the criteria, we found that the proposed self-storage facility meets the purpose and intent and intent of the Stockbridge Unified Development Code. The proposed self-storage facility meets section meets the requirement of section A. [2:18:33, 2:18:53]: of section one point four because it can promote the safety and general welfare by providing a s secure place for nearby and incoming residents and nearby businesses across from the Davis Pimit Pavilion Shopping Center to store their belongings. The development meets both Section B and Section C since it prohibits eighteen woolers from accessing the site once the construction is completed. [2:18:53, 2:19:05]: Complete. The prohibition of 18 wheels decreases the traffic impact on Davis Road. In addition, the development can meet Section H since the site will be clean and well managed. So as we went through our uh [2:19:07, 2:19:11]: criteria and objectively evaluated um [2:19:13, 2:19:21]: The list of requirements, the um we found that this applicant's request was pretty consist consistent with our code and future land use plan. [2:19:24, 2:19:31]: Let me get to the mail. So as a result, staff did recommend approval with eight conditions. [2:19:33, 2:19:53]: Condition number one, the site plan shall be developed similar to the site plan that was submitted by the applicant on August 8, 2024. The developer shall provide a 40-foot buffer along the eastern side of the property adjacent to Stockbridge Estate's mobile home, a 15-foot buffer along the western side, adjacent to Davis Pavilion Shopping Center, and a 15-foot [2:19:53, 2:20:13]: Foot buffer along the southern side, adjacent to Walmart Shopping Center, in accordance with section 3.2.34F of the Stockbridge Unified Development Code. Condition three relates to the architectural standards. Each building must have at least 50% of its exterior on all four facades constructed with. [2:20:13, 2:20:21]: With brick, stone, or a combination of these materials. The number of rental units shall be limited to a maximum of 247. [2:20:22, 2:20:42]: Condition number five, flock cameras shall be installed at the entrance of the facility. Condition number six, street lights shall be installed around the perimeter of the property. Condition seven, ingress and egress, ingress and egress must be up must be provided for the fire by the fire marshal for all buildings. The self-stored [2:20:42, 2:20:49]: Facility must be enclosed with a gate. So those are the eight conditions of approval that staff recommended for this project. [2:20:51, 2:21:11]: Okay, thanks. Okay. Yes, sir. Go ahead, please. Uh m Mr Standard, would would you re-emphasize um the ingress and egress location? And would you put up the graphic that shows the uh 247 units? Okay, I'll go back to that, sir. But uh [2:21:29, 2:21:30]: Okay. [2:21:31, 2:21:36]: That shows the that's a rendering of it. But I might have a better side plan. [2:21:36, 2:21:37]: Uh [2:21:38, 2:21:48]: Go back one. That one. I think it's two hundred and forty seven. That's a total of two hundred and forty seven. Yes, sir. So we limit it to no more than two hundred and forty seven units. [2:21:48, 2:21:56]: And and the uh ingress and egress is is it uh Davis Road or is it that side street, so and I don't know the name of the street. [2:22:04, 2:22:05]: Do you know the name of that district? [2:22:06, 2:22:08]: Yeah, you got uh [2:22:11, 2:22:12]: Okay, that's another one. [2:22:13, 2:22:21]: You see right here it goes onto Davis Road? Okay, okay. You see Council Member Thomas? I'm sorry. You see where my curse is? Yes. Onto Davis Road. [2:22:22, 2:22:22]: Okay. [2:22:30, 2:22:43]: And and and the green dots are those are that's landscaping. Okay. Yes. And the gray part are are the are the units. That's the concrete and the those are the uh the units. Okay. [2:22:44, 2:22:51]: That's the payment rather. Okay. Well may I I yield to see if other council members have any discussion. [2:22:52, 2:22:55]: Any questions right now from Mr. Anderson about the rezoning aspect? [2:22:56, 2:23:00]: If not, how about the the applicant? Uh could you come to the podium please? [2:23:06, 2:23:13]: Please introduce yourself and and name and address. Yes. Bob Nesbitt, twelve thirty five Lionsgate Drive, Carnage, Georgia. [2:23:14, 2:23:18]: Rogers Gautier, twelve thirty six Avenue on Drive, Connus, Georgia. All right. [2:23:18, 2:23:32]: All right, gentlemen, you've been listening to the presentation and uh our comments. What what do you have a a presentation of your own or comments do you want to answer? Yes, we do have a presentation. I believe I sent over the PowerPoint. Is that available? [2:23:49, 2:23:50]: What is one now? [2:23:59, 2:24:00]: Can't close this out. [2:24:24, 2:24:35]: I'm I'm ready. Go right ahead, sir. All right. Good evening. Uh first I'd like to say thank you to the mayor, to members of the city council, as well as to the staff, and thank you for the opportunity to present our proposal. [2:24:36, 2:24:55]: May it please this this commission, uh uh this city council that we would like to say on behalf of B One Home Improvement that we are here to tell you exactly what we intend to do and how we feel that this can benefit the community, the people that live in close proximity, as well as the city of Stockbridge as a whole. [2:24:55, 2:24:56]: Okay. [2:24:58, 2:25:05]: Uh first this is and I think you've seen it earlier, this is exactly how uh it sits on the land. This is a survey of the land. [2:25:06, 2:25:23]: This shows the construction. It's going to be brick on all sides except for the front where there's gonna actually be the door where people can enter and exit from the storage facility. But it's gonna be brick on all sides as well as brick on the front except for where the doors are located and that's what this elevation shows. [2:25:25, 2:25:45]: Here where you see uh the yellow that's going around, that's the actual land itself. Directly behind it you see is Walmart. And behind there is the area where the Walmart will have their trucks that will come in and deliver their goods and products to provide for that particular store. If we look over here [2:25:45, 2:26:05]: Here on this side here, this is a a mall area or a strip mall or a service area where people go in and purchase from retail businesses right there on that side of it. In the front is going to be Davis Road, and to the side, uh to the back are some homes that are back in that area. [2:26:05, 2:26:11]: And then there are or there is a facility that is doing business uh right next to it. [2:26:14, 2:26:22]: This is a picture of that area where the uh where the mall is, where people had can go in and purchase retail goods and services. [2:26:23, 2:26:27]: And that is just another picture of that particular location. [2:26:28, 2:26:48]: This is a facility that is directly to the right. They sell wood. They actually burn wood on the site, chop wood right there, right next to where our property is. That if we go back up uh and we look here, uh right here on this side here on the front that fronts on Davis Road is this particular [2:26:48, 2:26:50]: [8812.8, 8820.9]: Is not something that we think is favorable. There's another picture of of what it looks like that's right there on Davis Road. Uh you can even see the smoke that's going up. [2:27:03, 2:27:23]: We intend to improve, enhance, and hopefully make this a better community. What we find is that right now there are a number of homes that are being built in close proximity. Those people need a place to store their goods. The businesses that are there near Walmart, and also those retail businesses, as well as small businesses. [2:27:23, 2:27:43]: Business owners also need a place to store their goods. This will help in meeting that need and fulfilling that. This here is a picture of what it will look like. This is our rendition of what the landscaping will look like. It will be beautiful, it will be aesthetic, and it will be something that when you drive by from the road, that it will look not. [2:27:43, 2:27:50]: Nice. It will be something that you would see in any other major city throughout the uh Georgia area. [2:27:52, 2:28:08]: This is the type of fencing that we'll have. It'll be wrought wrought iron or wrought iron looking fencing that will be very uh aesthetically pleasing and it will be at least eight feet high and it will be something that will when someone drives by, it will be something that is very nice. [2:28:10, 2:28:12]: This is what the front of the storage units will look like. [2:28:19, 2:28:26]: This is also what it will look like where someone can easily drive up. They can load and unload their goods as they go in and out of the facility. [2:28:28, 2:28:35]: This here is just a picture just showing someone that how they would actually put something on the dolly, go in and out of the storage unit. [2:28:36, 2:28:56]: Now let's talk about some of the things, some of the concerns that this city council may have. What are the benefits of a storage facility? First of all, it is convenient for the residents, it increases property values. Why are we saying that? If people do not have a place to store goods, if they have items that now are [2:28:56, 2:29:16]: Exceeding and going into the yard, then it creates clutter, it creates a look that is not beneficial to the community, and as a result, property values go up. In areas where you have storage units that can be used, you tend to find that people will not have clutter in their homes. It will make the areas look nice and it enhances the value of your community. [2:29:16, 2:29:21]: It enhances the values of those homes and it makes for a nice place for people to live. [2:29:23, 2:29:43]: Uh it reduces clutter. Clutter is very important, and that's one of the main purposes of the storage unit. It's low impact on traffic. So now when we start to talk about what's going in and out of that facility, you're not going to see a whole lot of traffic. It's not going to put a burden on our roadways. It's not going to cause for us to have to build new roads. [2:29:43, 2:30:03]: It's going to be something that will be available for people to go in and out at reasonable times and reasonable hours, but it is low impact on traffic. This will be a state-of-the-art facility. It will be something that is virtual. People can go in and out. There'll be cameras all day long. It will be monitored by cameras. [2:30:03, 2:30:23]: And when people uh register to get it, they will do it online. There's no office, no personnel that is there, and we will have all of the equipment that is necessary in order to support having a state-of-the-art storage facility. This differentiates from the other storage facilities in the area. So I think the one that we were talking about there's going to be [2:30:22, 2:30:27]: be proposed. This is a two-story facility that also has a basement. [2:30:28, 2:30:48]: We have no basements, we have no two stories. It's not something that when someone drives by, they're gonna see some high-rise facility. What they're gonna see is the rendition that we have where it's gonna be trees and shrubs, and it will be aesthetically pleasing, and it's something that will enhance the look in that neighborhood in that area as opposed to what you have on one side. [2:30:48, 2:31:06]: A gentleman that has a a lumber yard where he's chopping wood, burning wood, and on the other side, we have retail businesses directly behind, you have Walmart. So this is something that will fit into the area, it will enhance the area, and it will also provide a service for those people that live there. [2:31:08, 2:31:28]: It is environmentally friendly. It is not something that is going to create uh any type of smoke in the air. It's not going to do anything that's going to affect the water. It's not going to do anything that's going to affect the ground, the soil. It is something where people will go in and out and they will use that facility in order to benefit them so that they can have a better quality of life. [2:31:27, 2:31:28]: [9089.5, 9109.5]: It also is a support for small businesses. We have talked with numerous small businesses, and one of the major problems they have is that when they are out and they have inventory that comes in and now they don't have enough room, what do they do? They go to a storage facility. When you have uh small uh construction companies that are doing business, they need to have [2:31:49, 2:32:05]: have their equipment somewhere instead of leaving it outside where it is an eyesore to our community and it's also open to theft, they can bring it into the storage unit and this is where they can keep their equipment and it provides a service to them and it also helps to provide beautification to our areas in our community. [2:32:07, 2:32:27]: When we look at this, this is adaptive to the land use. This is the highest and the best use for this particular property. If we really look at it, no one is going to want to build a home or have a residence where you have Walmart directly behind you with trucks going in and out on one side, and you have a retail facility that's selling uh goods to customers and and cars and traffic. [2:32:27, 2:32:29]: going out all day long right next door. [2:32:30, 2:32:50]: This is something that can fit in and it will not be a disturbance to the other businesses that are there. It won't be a disturbance to the homeowners that live in that community because it will be a service that will prov be provided. And the way that we have it set up with the trees and the shrubs and the fencing, it will be aesthetically pleasing. It will not be an eyesore. It will upgrade. [2:32:50, 2:32:51]: The neighborhood. [2:32:51, 2:33:11]: Mr. Nesm, before we go on the next slide, I just uh something just came up and I just want to reach back and catch this. This would be one story, several different buildings, eight different buildings, if I understand, right? That's correct. One story, only one story, three quarters really brick. Uh because the front side you got the the you got the door that goes up, so you can't brick you can't brick that thing. Just the post that are brick. [2:33:11, 2:33:25]: that support the building but other than that the door. Okay. That's correct. Now if I if I I might have heard this and I just need to get clarification. Did you say that there would not be anybody in any support staff on site? That is correct. Okay. So I rent it [2:33:25, 2:33:45]: So if I what if I have a problem, troubleshooting, anything like that, how do how do I get assistance or how do I even sign up? We have a customer service number where you can call in. We also have someone that electronically can open and close the gate and also can monitor a facility. So the the the only issue that we have is that if someone comes in and let's just say uh they have a flat tire, well they [2:33:45, 2:34:03]: They call someone to come fix it. They have a cell phone, they can access any help that they would need. So there's no no real issue in terms of someone physically being there because generally speaking, uh the only reason that person is there is to collect money or to sign someone up. All of that is done online. [2:34:03, 2:34:19]: And and I might add that in terms of emergencies, twenty four hours emergencies, it's tied into the video integration system, the VIC system, the security is. So anything that's necessary, we would definitely be tied in into the um emergency management system of Stockbridge or Henry County. [2:34:20, 2:34:39]: All right. So be it. Thank you. Okay. Yes, sir. Go ahead, please. While we're on that subject, and you mentioned a couple of things. Um and and what shot to my mind was theft prevention. Um other units [2:34:40, 2:34:41]: Climate controlled. [2:34:42, 2:34:44]: No, sir, the units are not climate controlled. [2:34:45, 2:34:51]: 'Cause see w one thing I've learned, cause I have used storage facilities in the past that [2:34:52, 2:34:56]: mold and mildew will create [2:34:56, 2:34:59]: If you know the change in other heat. [2:35:00, 2:35:17]: the coldness, the Marsha, et cetera, et cetera. So I would be a little concerned about that. Um and be honest with you, I'm I'm not familiar with the wood burning company. I would think that the smoke would probably penetrate [2:35:17, 2:35:18]: The units [2:35:19, 2:35:39]: And smell up your goods. And I'm I'm not gonna ask Mr. Anderson now, but that is a question I wanna ask asked about this this wood burning company because I wasn't familiar with that, but I'm glad you brought that up. Yes, sir. Well, I just drove out there today. As a matter of fact, those pictures were taken today. Yeah. [2:35:39, 2:35:40]: Uh and the [2:35:40, 2:36:00]: That smoke goes up into the air. It's not something that that blows across into uh where our facility would be located. I'm I'm sure it could if there was a wind or something of that nature. But the way it is, it goes straight up and it creates a plume in the air. Uh and that's that's why we're looking to do something that we feel is conducive to that area that will be a [2:36:00, 2:36:20]: Upgrade that will be an improvement. And if you look at our our drawings when we did the rendition, it's something that's gonna be nice. It's gonna it's gonna almost look like there's an office complex there as opposed to what the traditional storage unit is like. Like we say, this is the state of the art uh facility that was set so that one, it's it's [2:36:20, 2:36:40]: Now, what we do now in 2024. Everybody does everything online. You go on the phone, you tap it in, you make contact, you sign everything online, you register, they give you your code, you drive up, you have to have your particular code, and you also have to scan. It allows you to go in. We have the state of the art. [2:36:40, 2:36:45]: Security system so that it's tied in to Henry County andor. [2:36:45, 2:37:05]: uh the city of Stockbridge, so that any issues that may occur, those can be addressed immediately. And and I think one of the biggest things that that we look at from a from a city standpoint, and and this is just an opinion on my part, is that we look at things that one, that don't create a burden on the city, and that two also bring in additional tax revenues. [2:37:05, 2:37:25]: If we look at a storage facility, it it's it's different than residential, because with residential, now you have occupants, which means that you're gonna have to have police protection. You're gonna have more uh incidents of fire, so you need fire protection. It's gonna be a drain on the water system, it's gonna be a drain on the emergency system, and you only get property taxes. With this particular piece of property, [2:37:25, 2:37:45]: You will get property taxes, but it will also generate tax dollars from sales of the units. And very if you have very little need for police, you have very little need for uh fire, uh, very little need for water, very little need for emergency, and also it it it it has no additional students to the school system. So this is something that [2:37:44, 2:37:54]: benefits and I think it's a win-win for our community. Uh we also look at it from the viewpoint that there is ninety-two percent occupancy of the storage units in the city of Stockbridge. [2:37:55, 2:38:15]: The only reason that it's not 100% is because when someone moves out, then it takes a period of time for them to find the next person to rent that facility. So there is a need, there is a demand, and that's why you see uh units trying to come in because there's a need for supply. Supply meets demand, demand requires supply. So uh we're we're trying to do that. [2:38:15, 2:38:35]: We're trying to meet that need, we're trying to meet the demand, but we're also trying to do it at a level that will enhance and improve and and make Stockbridge look better when compared to what's in that area. And that's why I took some pictures today. I d actually drove out there today to take pictures so you can see what is there and what it what it could be. [2:38:35, 2:38:55]: And that's the purpose of what we're trying to do. There's uh uh in the next uh slide here we have amenities and features of the storage facility. It's advanced security measures, which we've talked about, user online booking system, flexible renting terms, competitive pricing. We are pricing ourselves so that we will be [2:38:55, 2:39:12]: beat any competitors in the area where we bring in lower prices, better services. And how do we do that? We do that because with the technology that we're using, we're not incurring the same cost that they are incurring to run their business. Because everything is done online, everything is digital, everything is state of the art. [2:39:13, 2:39:32]: It's a dedicated customer service and we're catering to the needs of the local community. And one of the slides that will be forthcoming will talk about what we've done in order to be able to make the statement that this is something that's catering to the needs of the community. It's aesthetically designed for enhanced beautification. [2:39:34, 2:39:54]: When we look at that, what what are some of the specific benefits? It's declutter of homes. Storage units provide extra space for households for us to store their belongings. Seasonal storage. Families can store items for holidays, for decorations, for recreational equipment, for off season clothing. [2:39:54, 2:40:14]: And for keeping their homes and their houses organized. I bet if you polled everybody in this room, as well as probably some of you on the council, we've all used a storage unit at some point in time. We've all had a need for a storage unit at some point in time. And even if there are disasters, then people need storage units. In Conyers, we had the [2:40:14, 2:40:34]: The issue where we just had a chemical plant that had a a big chemical burn. A lot of people had to be evacuated. What is the first thing that happened? All of the storage units were filled to capacity, and they even had to go outside of the local area in order to have a place to put their needs and their goods. So these things, even though it may not be the [2:40:34, 2:40:36]: The thing that we always think about that [2:40:37, 2:40:57]: We should have in our community, it's really a need that that should be uh uh addressed and needs to happen. And when you start to have facilities where there aren't enough storage units, you'll start to see the clutter build up in your neighborhoods, you'll start to see uh trash and other things that come along with it, stray animals and pets going after those things. [2:40:57, 2:41:01]: things uh storage units are really something that is needed. [2:41:04, 2:41:24]: Somewhat what are some of the key factors? There's been no opposition from the local community. We've been to a few hearings here, we've talked to people in the community. There basically is very little to no opposition when you begin to explain to them what we're trying to do and they see the type of storage facility that we're going to put forth in your community. [2:41:25, 2:41:32]: It has passed by the uh planning commission. It's also recommended uh here by by your staff. [2:41:33, 2:41:47]: Uh we did a market survey. We hired a firm that did a market survey and they pulled people in the area where these homes are located where the homes are located in close proximity, and 88% of the residents were in favor of a storage unit. [2:41:49, 2:41:52]: As a matter of fact, many of them used storage units. [2:41:53, 2:42:13]: There is a 92% occupancy rate for storage facilities in the city of Stockbridge. This is the highest and best use for that land. If you look at it, what can we really put there that's going to be able to benefit the community and also not be a burden on this on uh the city of Stockbridge at the same time? It will bring in additional tax revenues. [2:42:13, 2:42:22]: Such as sales taxes and property taxes. It reduces the burden on the city from the viewpoint of police, fire, water, schools. [2:42:23, 2:42:43]: as as well as emergency needs. It's low impact on traffic. And we have limited our hours of operation from people coming in and out from 7 a.m. to 7 PM, primarily through most of the daylight hours. So there's not going to be any late night traffic. There's not going to be any incidents of things that are occurred. As as was said, there's going to [2:42:42, 2:42:59]: be need for a flock. There are also going to be security cameras. So this is something that's going to be safe and secure. And it's very little crime that you find that occurs at storage facilities. So with that, we're willing to answer any questions that you may have. [2:43:01, 2:43:03]: Any questions, Council? Any additional questions? [2:43:05, 2:43:12]: Is Barber you have something? Go ahead please. I do. Um so the poll that you mentioned or the survey that you did. [2:43:13, 2:43:20]: Were those residents aware that there is a storage facility coming um already approved or coming across the street? [2:43:20, 2:43:40]: Uh to to be very honest with you, I I don't believe that the people that were taking the poll informed them of other storage units in the area. Right. They were speaking in general about is there a need and what do they have any objection to a storage unit. And many of them said eighty eight percent said that they were comfortable and in favor of a storage facility. [2:43:40, 2:43:43]: And many of them said that they had a need for storage facility. [2:43:44, 2:43:57]: And I would honestly I would have supported your proposal and your request had it not been for the other storage facility that's already coming. [2:43:57, 2:44:10]: Um that's that's the only challenge that I have. We already have one that's coming and there's already another storage facility um less than a mile away. That's that's my only challenge there. [2:44:10, 2:44:30]: If if I may respond to that, and I and I do appreciate your opinion and I do understand uh the point that I want to make is that our storage facility is heads and tails above these other facilities. Our our unit is something that is beautiful and aesthetically pleasing, and it's something that when you [2:44:30, 2:44:40]: When you look at it from the ground, it's not far up above ground where it's an eyesore. It's something that is going to enhance and improve. And it was designed with that in mind when it was done. [2:44:41, 2:44:48]: I get it. And honestly I would have supported it had it not been for the other one. That's what I'm challenged with. Um [2:44:50, 2:44:50]: That's all. [2:44:51, 2:44:53]: I I do appreciate that viewpoint. Thank you. [2:44:53, 2:44:54]: Any other questions from the council? [2:44:56, 2:44:56]: Okay. [2:44:57, 2:44:58]: If not then uh gentlemen. [2:44:58, 2:45:07]: I guess if what Pullman uh nothing else to say right now, you can have a sitting on open up for the public hearing. Okay? Yes, sir. No problem. Thank you. Thank you. We appreciate your time and your consideration. Thank you very much. [2:45:08, 2:45:16]: Okay. All right. In favor? Anybody in favor of of this um particular storage unit? My far left hand side over here. Any comments? [2:45:16, 2:45:19]: Anybody in the middle? Any favor? Any comments? [2:45:20, 2:45:23]: For our right side. Any comments in favor? [2:45:23, 2:45:27]: Okay, any any comments against uh this tour storage facility? [2:45:27, 2:45:30]: Yeah on the far left side. Anything in the middle. [2:45:30, 2:45:31]: Anything on the right side? [2:45:32, 2:45:36]: All right, no comments for favor or against for or against. So I'll close out that part of the public hearing. [2:45:37, 2:45:39]: Uh Mr. Anderson, come back to the podium, please. [2:45:46, 2:46:00]: All right, what we have here, if there are no other comments uh from the council, then I'll go through this process uh for approval or disapproval. Comprehensive plan amendment case CP two zero two four-07 for uh uh property located in council district two. [2:46:01, 2:46:21]: Consideration of comprehensive plan amendment request for a change of land uh future land use designations for four parcels on the south side Davis Road as identified below. From the current split future land use designations to low density mixed use to the entire for the entire property for the purpose of allowing the the construction of self-storage well. [2:46:21, 2:46:41]: Warehouse development, excuse me. The property owner is B1 Home Improvement LLC and the agents are Robert Nesbeth and Rogers Gutierrez. The property is located in Landlot 71 District 12 and contains 6.895 acres. Address 649 Davis Road parcels S05. [2:46:41, 2:47:01]: Contains three point six zero five zero acres, current future land use designations, low density residential and medium density mixed use. Address six five seven Davis Road parcels S05-0800-3000 contains [2:47:01, 2:47:21]: Contains point six six acres, current land future land use designation unassigned. After 681 Davis Row parcel S05-08005-000 contains 1.34 error acres. Future current future land use designations, low density residential and medium density. [2:47:21, 2:47:41]: Mixed use. Parcel number S05-08006-000 on Davis Road. Contains 1.29 acres. Current future land use designation low density residential and medium density mixed use. All right, council, is there a motion to approve or deny this particular comprehensive plan? [2:47:40, 2:48:00]: make one comment. Yes, what's that, sir? Let me just say this to the council. And I've looked at the uh proposals, I've listened to everything that's been said. But look, I'm just the issue with me is that I don't know who who they surveyed, but I've I haven't seen anybody in the community that supports. I keep hearing over and over [2:48:00, 2:48:20]: Again, the the citizens want to see something better than this. They want to see better options. They want to see retail. They want to see restaurants. Yet we keep getting the same proposals. And we're gonna keep getting the same proposals with a yes vote tonight. I can't support this, so I'm not gonna vote for it. And it's up to you all to determine what you would do. [2:48:20, 2:48:23]: But in my opinion, I can't support this. [2:48:25, 2:48:29]: All right, there's uh there's a motion to approve or de or disapprove or approve this [2:48:29, 2:48:31]: Company's plan amendment. [2:48:33, 2:48:34]: Is there a motion? [2:48:36, 2:48:44]: All right. Mayor Ford. Yes, ma'am. I do I wanna ask a question of Mr. Gardner. And forgive me, Mr. Gardner, for putting you on the spot. [2:48:46, 2:48:49]: So, this is one of those situations where [2:48:52, 2:48:54]: We don't want a truck stop. [2:48:54, 2:48:55]: Mm-hmm. [2:48:57, 2:48:59]: But what kind of [2:49:00, 2:49:03]: Undecided about this public storage facility. [2:49:03, 2:49:11]: We don't want high residential townhome community built there. That area is already highly populated. [2:49:14, 2:49:20]: I understand with this public storage facility that it's less traffic. [2:49:21, 2:49:30]: I get it. They are low burden on the city's resources. But in terms of [2:49:30, 2:49:35]: Developing the area with more desirable. [2:49:35, 2:49:36]: Commercial. [2:49:36, 2:49:40]: Not saying that this public stores facility is not desirable. [2:49:41, 2:49:43]: Because I would have considered this one. [2:49:44, 2:49:47]: As opposed to the other one that's right on the corner of [2:49:48, 2:49:49]: North Henry. [2:49:51, 2:49:55]: What would you suggest going forward? Um or [2:49:56, 2:49:57]: At any point. [2:49:57, 2:50:00]: In this particular area of Davis Road. [2:50:00, 2:50:02]: Well we have the town home. [2:50:02, 2:50:03]: Development is coming. [2:50:04, 2:50:05]: In my district. [2:50:06, 2:50:06]: Um [2:50:06, 2:50:09]: and even off Valley Hill Road. [2:50:10, 2:50:11]: Because I know [2:50:12, 2:50:13]: Our future land use map. [2:50:14, 2:50:16]: Um, we're not anticipating [2:50:16, 2:50:17]: Well [2:50:18, 2:50:20]: What would you suggest? [2:50:22, 2:50:30]: So, um, Councilmember Barber, um, you know, what I may suggest is [2:50:32, 2:50:32]: No. [2:50:33, 2:50:53]: I don't know if I should we should use that as a criteria um for this specific project. Um but I would say, you know, you you gotta look at it um make sure I get the right. You gotta look at it based on on on the merits of the application. [2:50:52, 2:50:55]: Um [2:50:56, 2:51:03]: I think if I remember correctly, when this came when they were annexing back in oh three, um [2:51:04, 2:51:21]: I I remember correctly, there was proposing to combine and put a subdivision in here, but I don't think that it that I think that fell through shortly after it came into the city and that's why it's been what it's been. Um, the only thing that got built over there was that strip center right there. [2:51:22, 2:51:32]: um adjacent to the Walmart that came in after the Walmart came in. Um because I remember approving that um back in oh two, somewhere around there. Um [2:51:33, 2:51:41]: It's hard. I mean, there is a defining break line as it relates to this project. Obviously, you can't get any more commercial along this corridor. [2:51:42, 2:51:44]: Um the vacant track here is being developed. [2:51:44, 2:52:04]: Um at some point you'll probably see the the trailer parks probably in the next twenty five years, depending on what happens in this area, will probably come up for development. But in terms of a commercial use, this would literally be the last portion of what that area would be. Um just because it's it's [2:52:04, 2:52:08]: Boxed in by residential projects. Um [2:52:09, 2:52:15]: It's up to the council to determine if this is you think is this is the highest and best use. I mean, at this point. [2:52:15, 2:52:23]: um for the property. Um in light of the fact that you just put one literally a fifth of a mile away. Um [2:52:24, 2:52:28]: So that's that's a that's a tough decision to make. Um [2:52:29, 2:52:34]: But, you know, staff looked at it through the analysis and determined that, you know, based on all the factors. [2:52:35, 2:52:40]: Um unrecommed approval. The planning commission did the same, reviewing the staff analysis of it. [2:52:41, 2:52:45]: Um but once again this is a legislative decision, so regardless of that, you guys still [2:52:46, 2:52:47]: You have the final say. [2:52:48, 2:52:48]: Um [2:52:49, 2:52:51]: Could we get something better in there? [2:52:51, 2:52:51]: Maybe. [2:52:52, 2:52:53]: Oh [2:52:53, 2:52:55]: But we don't know when that will be, obviously. [2:52:57, 2:52:58]: So [2:52:58, 2:53:06]: Literally without answering yes or no. It's kind of kind of a situation we're in with this parcel with this this group of parcels. [2:53:09, 2:53:10]: You're welcome. [2:53:10, 2:53:12]: Yeah, for a few please. [2:53:12, 2:53:20]: I I'd just like to say to to the to the gentleman that I I just want to commend you for [2:53:21, 2:53:27]: actually, you know, coming forward and actually even owning the property. Uh for me [2:53:28, 2:53:36]: I I really think this is a i i it it's a valuable piece of property. I really do. Looking at the location [2:53:36, 2:53:47]: I grew up here in Stockbridge and uh and I remember and I hope the council don't mind me going the long version with this, but I remember where the Walmart is. [2:53:48, 2:53:48]: Um [2:53:50, 2:53:51]: The cotton fields. [2:53:52, 2:53:53]: M. L. King senior. [2:53:55, 2:53:58]: uh head a um a sharecropper's [2:53:58, 2:54:01]: Shack where that service station is at Walmart. [2:54:01, 2:54:06]: So my point is that I think this is a valuable piece of land. [2:54:06, 2:54:08]: But as I mentioned before, for me [2:54:10, 2:54:13]: I try to look to the future good. [2:54:13, 2:54:15]: of a particular area. [2:54:16, 2:54:17]: And I know once [2:54:18, 2:54:20]: Whatever you put in there. [2:54:20, 2:54:22]: That's gonna be the trend. [2:54:22, 2:54:26]: And and I don't think we have support tonight for it, but [2:54:27, 2:54:38]: I'll be I'm just a little reluctant to set that trend tonight with storage units. I I am personally. Um [2:54:40, 2:54:43]: But I think this is a great piece of property. [2:54:43, 2:54:45]: think is a valuable piece of property. [2:54:46, 2:54:48]: Just looking at the location. [2:54:48, 2:54:51]: And in all our discussions [2:54:51, 2:54:53]: And our land use plan in [2:54:53, 2:55:03]: You know, you look at that particular area, you know, that whole 138. And see that is the reason why um highway forty two is being widened. [2:55:04, 2:55:05]: Because [2:55:06, 2:55:08]: Everyone see the future. [2:55:08, 2:55:10]: for that particular area. [2:55:11, 2:55:13]: And that gives you some indication that [2:55:13, 2:55:16]: That's a valuable piece of area there. [2:55:16, 2:55:18]: But I just don't know from [2:55:19, 2:55:21]: From our standpoint [2:55:22, 2:55:23]: And turn to [2:55:23, 2:55:26]: forteil the future. [2:55:26, 2:55:28]: With land use. [2:55:29, 2:55:32]: I just don't know if this is the product. [2:55:33, 2:55:38]: that we wanna see right now in that location. I understand the need in like [2:55:38, 2:55:42]: Councilwoman Barber said, There's one already planned. [2:55:43, 2:55:45]: There's one already down the street. [2:55:46, 2:55:49]: So uh I just think that um [2:55:50, 2:56:10]: The timing is bad. I I just really do so. Um I just think you know you you really won't get support tonight on it. Uh I hate to say, you know, uh to turn it down. I I just don't think it's a pass tonight. Um six months from now, I I still don't know. A year from now, I still don't. [2:56:09, 2:56:11]: Yeah. [2:56:11, 2:56:12]: Um [2:56:13, 2:56:19]: to say that if you could come up with another project on the same property, you know, I d I don't know. [2:56:20, 2:56:23]: But I just think this product right here tonight. [2:56:24, 2:56:25]: I just don't think [2:56:26, 2:56:38]: there's any favorable recommendation or vote tonight for a storage unit on that piece of property tonight. I I just don't think it's there. [2:56:39, 2:56:40]: I year back, Mayor. [2:56:41, 2:56:44]: No problem. Call so I need a motion to approve or disapprove, please. [2:56:47, 2:56:47]: Any motion? [2:56:50, 2:56:54]: All right. I'll make a motion to deny the request. Okay. [2:56:55, 2:56:56]: You have a question? [2:56:56, 2:56:56]: No. [2:56:57, 2:57:05]: gonna say well we i i there's no motion to deny. It's either you make a motion for the agenda item, whether you're gonna approve it and then you leave it or it just dies. [2:57:06, 2:57:10]: Well, if no one makes a motion it will die. That's true. That's why I was just waiting. But [2:57:10, 2:57:11]: But uh [2:57:11, 2:57:23]: But it's a approve or deny. And it's either you we either approve it or it just dies. Well, if we if there's not a motion then it will do it before. But if it if we don't have a motion it will die. Okay. [2:57:25, 2:57:25]: Toll. [2:57:26, 2:57:32]: No, it would just be lang languishing out there. But if we officially deny it, they can't come back for six months or a year. [2:57:32, 2:57:44]: I don't know what's what is the decision on what if it if it is denied, what what's excuse me now? A year a year. A year. There you go. There's your answer. Now, is there a motion to approve? [2:57:46, 2:58:00]: Uh my motion was to deny it. I think we've had it and every last one of us have heard that our citizens don't are tired of getting this type of development again and again. All right, fine. So you got a motion to deny. Is there a second to that motion? [2:58:02, 2:58:04]: Mr Mr Berry Second, all in favor, please indicate. [2:58:06, 2:58:12]: All posed. Well wait a minute. I all everybody. Four deny. All all all all agree. [2:58:13, 2:58:15]: Okay. You okay on all polls? [2:58:17, 2:58:18]: Uh abstentions? [2:58:19, 2:58:26]: We have for everybody voted to deny. No, uh no, uh uh Mr Thomas is of uh still stains. Miss Barber, you voted [2:58:28, 2:58:30]: To to deny. [2:58:30, 2:58:31]: To deny. [2:58:33, 2:58:53]: I'm I'm clarifying. I voted to deny. Okay, good there we go. So it it the motion passed with a di well for motion passed to deny. All right, so it's four zero one. All right. Rezoning case R Z two zero two four four four four four four dash zero four. Point of order. Yes. I think without the comprehensive plan it really can't go forward anyway, right? From fast case, so so you're telling Tim, well, legal opinion, do I need to go through the process of reading this w or not? [2:59:06, 2:59:07]: Screaming. [2:59:07, 2:59:27]: That's what I thought. It has your applicant request of uh withdrawals but it says in front of me. Y Yes, sir Mayor on the on the on the advice of uh legal, uh they wanted counsel to make a motion to accept it. [3:02:39, 3:02:41]: To accept the withdrawal. Okay. [3:02:41, 3:02:44]: Um it was determined that they didn't need uh [3:02:45, 3:02:55]: um sewer I mean a septic tank, so they can build uh they can build on a septic tank instead of s having required being required to have sewer connection. [3:02:55, 3:03:02]: All right. So as a result, they withdrew their application. Oh, they withdrew their application Yeah, so they didn't need the zoning. [3:03:02, 3:03:12]: Mayor. Yes, ma'am. That's not true. We we voted and we've had a discussion about this that everyone now would be required to have sewer. [3:03:14, 3:03:16]: Um didn't we have a discussion about this recently? [3:03:16, 3:03:19]: How recently? How many years ago? [3:03:19, 3:03:39]: Not let it hadn't been that long ago because there was a whole tax issue then we talked about sewage and we talked about septic. Uh uh we we we combed through the uh UDC and other and other uh city codes and it's not in it. And yeah, we probably need to add it and even water's available and sew is available everywhere. [3:03:39, 3:03:42]: Okay, stand by Ms. Holiday, you have something to add? [3:03:51, 3:03:56]: Mr. Deshitz was speaking of it. I remember that we talked about this. We said [3:03:56, 3:04:07]: that because there was a question on whether or not anyone else uh whether or not we're gonna make that a requirement. And there was is some federal law in regards to [3:04:07, 3:04:08]: Um [3:04:09, 3:04:15]: Items that have to be done. It's yeah. If they have access is required now. [3:04:15, 3:04:16]: And there's a requirement. [3:04:17, 3:04:19]: That may be the case, Councilman McGann, but [3:04:20, 3:04:21]: It's not in our coat. [3:04:22, 3:04:23]: So [3:04:28, 3:04:32]: So when they updated the UDC in twenty twenty two, they didn't include it in there. [3:04:33, 3:04:37]: Well then we're gonna have to amend that, but if there's no [3:04:38, 3:04:43]: I didn't hear this. We d we haven't received any opinion of this. Where's legal? [3:04:44, 3:04:46]: Well it was done by a zoning attorney, Ms. Valerie Ross. [3:04:47, 3:04:48]: We're we're legal. [3:04:49, 3:04:57]: Well she s she's here. We have Luke here, but but it's but it's only an attorney represented this or or talked to us about this, I guess. I don't know. I don't know if she can handle this or not. [3:04:59, 3:05:00]: Can you handle it legal? [3:05:01, 3:05:04]: Do you have any answers? Why don't you come to a podium please tonight? [3:05:05, 3:05:06]: Can we call a bell on the phone? [3:05:06, 3:05:10]: No. Ari? Could you come to the mic, please? [3:05:11, 3:05:18]: What w I just wanna understand something? Is there is they're not wanting to connect to the to so to water and sewer? What what is the issue? [3:05:20, 3:05:21]: Legal. [3:05:22, 3:05:22]: Please. [3:05:26, 3:05:28]: We're trying to cut to get the galaxy. [3:05:31, 3:05:40]: And you're looking for something specific, Mr Mar uh Mr. Scar? So the the history has been you can develop on Sioux on septic if there's no Sioux available. [3:05:41, 3:05:45]: Right. So most of your homes in unincorporated Henry County on [3:05:46, 3:05:53]: Three thousand thirty thousand square foot or or larger could be on septic as long as the property can show that it can perk. [3:05:53, 3:05:54]: Right. [3:05:54, 3:05:55]: Um [3:05:55, 3:06:02]: I was just asking Ryan. I think this track came in as part of the twenty twenty three annexation,'cause this wasn't in the city before. [3:06:02, 3:06:03]: Um [3:06:04, 3:06:12]: But usually that's what they require if you're gonna be on a septic system. But if I am not mistaken and I'm trying to see if I could find the map. [3:06:12, 3:06:15]: Дим де згадабі сур. [3:06:16, 3:06:21]: I know sewer serves the conven the B P on the corner. The requirements. [3:06:22, 3:06:25]: So yeah, so I I'm trying to figure out what that [3:06:25, 3:06:45]: What what the new standards is because I haven't looked at Henry County standards in a minute as a release deceptive. Henry County standards is if you have access to it unless they overrule it, then I believe you have to connect to uh available water and sewer. And I think the d water develop the water authority is assist upon that. If you're there and you it is there [3:06:45, 3:06:53]: They have to pay for that connection to it. The issue is um if you have a acre or more, you you you can be exempt from it. [3:06:53, 3:07:00]: Right, but these s lot certainly not gonna be a acre or more. We know ain't nobody coming here asking for that. [3:07:01, 3:07:21]: W well they they are it's close. It's not it's like one house per one point two four. It's gonna be an acre lot. They're reducing it to instead of having multiple, they want it to be large lot landlots. But how but what is the size of the single family residence? No, it's it's gonna be small. [3:07:21, 3:07:22]: Because it went from [3:07:22, 3:07:27]: They want rule. So that that was their initial plan. [3:07:27, 3:07:33]: was to do it's it's low density residential and if I when I looked on there it was like one point [3:07:33, 3:07:47]: It's one house per one point two acre. So it's like uh uh well, one unit per one point two acre. It's only four units and they divide'em into four lots. So it's four they expect'em to build four houses basically. [3:07:47, 3:08:05]: So that's what I have on it. That's what I've seen. Yeah, they're gonna be nice. I mean they're gonna be single family units, separate, four like four houses. That's what it looks like. No. I'm looking well I wanna double check. Yeah, this it's um [3:08:05, 3:08:07]: It's divided to four. It's one unit. [3:08:08, 3:08:11]: One point two one acres per unit. [3:08:14, 3:08:15]: And it's four units. [3:08:16, 3:08:20]: Doesn't you have to do a million dollars? [3:08:21, 3:08:25]: You can build a T pounds and open out, it can be a huge house. [3:08:25, 3:08:36]: It's four point eight four acres and it's they wanna change it from um to low density residential and they wanted to change the suburban residential it is now. [3:08:37, 3:08:40]: to rural residential. So it's definitely big lots. [3:08:41, 3:08:43]: It's r being changed to rule. [3:08:44, 3:08:45]: Because [3:08:46, 3:08:57]: So I don't object, but I don't want them to be on septic. Yeah. Right. Now that would be concerning. [3:09:02, 3:09:04]: Three. [3:09:07, 3:09:27]: Is excuse me, um, for the sake of time, Mr. Anderson and Mr. Gardner, if we can't get an answer to this portion tonight in regards to the septic issue, um, whether or not and then once we speak to public works, because I could have sworn we talked about this, that if they can connect to uh [3:09:27, 3:09:32]: of sewage, then they would be required to do so. [3:09:32, 3:09:50]: Um and if that is the case, then we need I need us to talk a little bit more to our legal department on that, as well as our um public works director, and then we can take this up during um the next council meeting. [3:09:52, 3:10:12]: Well right now, even though you made that request, they're just trying to find some clarification here. There's got a couple of folks research doing some research and and on the phone to see whether or not uh see what direction we probably need to go and understand your recommendation. But most were drawn by average, so we research it and determine that it doesn't leave and [3:10:12, 3:10:32]: They can move forward without our approval? Really? If we find out that it's they are required to then obviously just be back before you, they'll have to come back and resubmit. I mean technically if if they're covered and they don't have to, we can't need to be pushed them into something. [3:10:31, 3:10:51]: to the process right now right so but we're uh and that's I think that's where where I'm speaking to was through the zone attorney had to report because of the situation but I think he's also talking to the S about like I said I know for a fact that you know this piece came in there are [3:10:51, 3:11:00]: If you remember correctly, it was a portion of Black um falling waters, right? It's part of my village. And the only reason why they got built. [3:11:01, 3:11:04]: when Moral Rivers was first built, the the sewer line didn't support. [3:11:09, 3:11:15]: Yeah, it's I remember me and Michael Harris getting chewed up from the former district commissioner for [3:11:25, 3:11:26]: Uh to go to [3:11:27, 3:11:28]: Um [3:11:30, 3:11:40]: Right now there's no action needed so we'll go back and if there if there is, we'll we'll announce that they're they're having to submit if there [3:11:41, 3:11:50]: Well, this is on our agenda, so the I think the thought th thought process also is do we vote on this or not one way or the other? Or if if not then then's majority case. [3:11:50, 3:11:54]: So in your case, applicant would do what now? The applicant is requested. [3:11:55, 3:11:58]: Okay, so we have to we have to agree to that or we just drop it? [3:11:59, 3:11:59]: Yeah. [3:12:00, 3:12:06]: You could agree to it, but in essence you you're coming back to the same conclusion, which means they're not gonna be hurt. [3:12:07, 3:12:15]: Yeah, but uh he Mr. Anderson just said the attorney t wanted us to vote on the withdrawal. That's why we're having this discussion. [3:12:18, 3:12:19]: I don't understand. [3:12:20, 3:12:23]: You don't have the vote of withdrawal, they just withdraw. [3:12:27, 3:12:31]: Well what d we have a legal opinion on on the our way forward right now? [3:12:34, 3:12:38]: Ms. Turney, do we have a legal opinion on what what we need to do right now in reference since it's on the agenda? [3:12:42, 3:12:45]: I'm sorry. You gotta come to the mic, please. I can't hear you. [3:12:57, 3:13:00]: Anything near I was recommending. [3:13:03, 3:13:03]: Okay. [3:13:06, 3:13:16]: Evening Mayor, Council. My recommendation was to defer this for additional research if there's contention and conflicting information presented for the next meeting. [3:13:17, 3:13:18]: All right. [3:13:19, 3:13:24]: So if you recommend that, that's a deferral for both item twelve and thirteen. [3:13:25, 3:13:26]: If he gives a wallet. [3:13:26, 3:13:36]: All right. And that requires a motion to defer, since they're asking for withdrawal. I'm assuming. Yes. Try to make sure what we do properly here. [3:13:37, 3:13:49]: Mr Gardner, you got some go ahead Mr Gardner. Yeah, just move just move the taking any action off it to next week. It's already been advertised anyway, so just take it to the next meeting. [3:13:49, 3:13:55]: All right, which is Tuesday. Just okay. Well council, I need a motion to defer this till our next meeting, which is [3:13:55, 3:13:57]: Tuesday the seventeenth. [3:13:57, 3:14:02]: So moved. Mr Berry, is there a second? I second. All right, all favor, please indicate. [3:14:03, 3:14:04]: She now's decision on that. [3:14:05, 3:14:11]: That was for the compreh I guess that's c for the comprehensive plan amendment. I just I guess we need to do this for the rezoning piece as well, right? [3:14:12, 3:14:20]: Yes, sir. Okay, let's just do the same thing for resonant, please. So motion to defer until our next meeting, which is December seventeenth. Okay, for Mr. Berry, is there a second? [3:14:20, 3:14:35]: There's second but I it's I think it's in my district. It says council district. One and one and one in council district. Yeah, but the second one says council district two. It's it's really one. Okay. So we just want to make sure we get it right. Okay. All right. [3:14:35, 3:14:37]: So yes, I second. Okay, offer present okay. [3:14:38, 3:14:40]: I was deferred until the 17th. All right, we'll move on. [3:14:41, 3:14:42]: All right, Mr U [3:14:43, 3:14:51]: Gardner, you make sure we get get that back on the seventeen, right? Yes sir. We have a decision on that. Okay, so we'll move all the way down to seventeen. [3:14:51, 3:15:01]: Uh because other items have been deferred. And so the second reading, the adoption of the FY twenty twenty five operating budget operating budget and capital improvement plan. Mr Gardner, on you, sir. [3:15:03, 3:15:04]: Okay. [3:15:05, 3:15:06]: Thank you, man. [3:15:06, 3:15:07]: You're welcome. [3:15:11, 3:15:15]: Is that the one I sent you? Yeah, that's it. Oh crap, I don't think that's it. [3:15:15, 3:15:16]: Oh, that's [3:15:19, 3:15:20]: I think this is the wrong one. [3:15:21, 3:15:22]: This is November. [3:15:22, 3:15:24]: Yeah, so [3:15:40, 3:15:48]: All right, ma'am, council. Um today is the second read of the proposed FY twenty five budget. Um [3:15:49, 3:15:50]: I had a [3:15:51, 3:15:58]: smaller presentation available. Um since we did the in depth one um in November. But probably uh [3:16:00, 3:16:07]: My I think I sent the wrong one to the system, so I apologize for that. This is the one the lengthy version of it, but I will [3:16:08, 3:16:23]: cut through and get to the chase and then ask for questions. But um when we met um back on November twelfth, uh part of the presentation I presented to you guys was where this where the city was actually headed. Um [3:16:25, 3:16:33]: in terms of where we're moving forward or growth. And and these are estimates and as we know, those estimates are impacted by what's going on. And so we're [3:16:33, 3:16:36]: At our retreat back in August I mentioned to you that [3:16:36, 3:16:37]: You know. [3:16:38, 3:16:58]: The way the economic data was reflecting was that we were gonna see some decrease in interest rates. And as you know, the feds have now decreased interest rates twice. Uh so we're no longer in the eight percent range and as interest rates drop for as it relates to long term investment such as housing, what you're gonna see is uh [3:16:58, 3:17:02]: run on houses because obviously those homes are now much more affordable. [3:17:03, 3:17:05]: than they were this time last year. [3:17:05, 3:17:06]: Right. [3:17:06, 3:17:10]: Um and so when we talk about our growth, that growth is gonna happen. [3:17:10, 3:17:18]: Um, because of the amount of units that we've actually approved over the last five years, I think can somewhere in the range of almost five thousand units. [3:17:19, 3:17:39]: Um if you do just general math and times that by about 2.6, 2.7 house persons per household, that kinda adds to what's coming to the city over the next few years when those projects actually start moving forward, which many of them are in the process. Um I illustrated to you guys the growth of the city since 1996. [3:17:38, 3:17:47]: Up until this year. And so you see where the city has grown in some of those areas, even back in 1996. We can see where my cursor is, is Monarch Village. [3:17:48, 3:17:51]: And at the time that was under construction, that had not actually been [3:17:52, 3:17:56]: Homes weren't being sold then. They were starting to sell in nineteen ninety eight. [3:17:57, 3:18:00]: Um when that actually came online. So that was vacant line. [3:18:00, 3:18:02]: And if you remember, I think Mr. [3:18:02, 3:18:06]: Mr Thomas could attest to that used to be the old lion country safari. [3:18:06, 3:18:10]: Um, back in the day. So we had Lion Country Safari in Henry County and [3:18:11, 3:18:21]: Uh I remember when a resident, I think it was the HO president at the time, bought a home in the Monarch Village and was doing some work and dug up a boon and thought it was a human skull. It actually turned out to be a chimpanzee. [3:18:22, 3:18:26]: Right. So kinda give you a history of where we are. And so when you look at two thousand [3:18:27, 3:18:34]: twenty four and where we are, uh in terms of the city's growth. We're literally less than half a mile from the northern tip of [3:18:34, 3:18:35]: The city of McDonald. [3:18:36, 3:18:37]: Right, from Daily Mill Road. [3:18:38, 3:18:42]: to Jodico Road, as how close we are to actually touching the city of McDonough. [3:18:43, 3:18:45]: Um, so we're close in terms of where we've been growing. [3:18:47, 3:19:07]: Uh as we highlighted in our presentation um back in uh November, um some of the priorities that we want to see happening and obviously those with the passage of the SPLOSS, we'll see a lot of these projects moving forward over the next six years um because we are in a six year spLOS, so a lot of road improvements, sidewalks improvements will continue. Um we know [3:19:07, 3:19:18]: it as we increase in population and there's still a lot of land that's gonna be coming into the city. I I remind you that remember you have that Western parallel connector area between [3:19:18, 3:19:20]: Eagles Landing and Jodico. [3:19:21, 3:19:25]: That's coming in the city, that's over three hundred acres of undeveloped raw out. [3:19:25, 3:19:26]: It's [3:19:27, 3:19:39]: Partly in the city, about a hundred acres is still not in the city. But right now that's all raw land and that roadway is under construction. And as you've seen throughout our years living here, if you build a road, guess what's coming next? [3:19:40, 3:19:40]: Development. [3:19:41, 3:19:55]: Right. You don't see trees on on roads, especially this close to the interstate. So you know there's gonna be development and part of what um we're gonna do and talking to Ryan and his group is making sure that we start and we've already opened up conversations with Henry County. [3:19:56, 3:20:01]: Because I don't know how many of you guys remember, back in two thousand and ten there was an L CI study done. [3:20:02, 3:20:03]: In that area. [3:20:03, 3:20:23]: Um nothing happened over these last fourteen years, but we want to go back and revisit that with the county and the ARC to see which portion of that plan we can make um come back to fruition and plan that area ahead of the development coming before you guys. Um we talked about um no increase in our utility rates or our fees. [3:20:23, 3:20:28]: Um no movement in our millage rate. We're still at 3.77 mills. [3:20:28, 3:20:31]: Uh remember that we did have growth in our digest. [3:20:32, 3:20:33]: Of just under six percent. [3:20:34, 3:20:41]: Um, but we also saw growth in our lost because if you guys remember when we got the seven thousand residents in the city. [3:20:42, 3:20:48]: We went back to the county and we got an additional two point something percent increase in our lost [3:20:48, 3:20:53]: So high revenues have grown based on those two factors. And as you know, [3:20:53, 3:20:54]: This year you will see [3:20:54, 3:20:58]: A lot more development coming online, whereas [3:20:58, 3:21:18]: Um in 2025, you know, Whataburg is is still undeveloped land, right? Um the sprout side when they did the assessment is still technically undeveloped, but you'll see those now coming into the tax digest for the city uh in 2025. So a lot of those commercial projects as they come on. [3:21:18, 3:21:26]: online will capture those new projects. And so you'll see growth in the digest there. Some of the special projects we want to continue working on. [3:21:26, 3:21:29]: Um the U Senior Performing Arts and Activity Center. [3:21:30, 3:21:50]: Um that's one of the major projects that's been out there and we want to get that project moving because it's been about four years um since we acquired funding for that, including moving forward on our parks. Um as you know, we were granted through an agreement with the Henry County Water Authority an additional twelve acres of property off of Eagles Land and Parkway for that Southside Park. [3:21:50, 3:21:58]: Want to be able to get moving on that, but also move on doing some additional planning through our parks master plan. Um [3:22:00, 3:22:04]: for the memorial for memorial park. And we we just recently [3:22:04, 3:22:12]: Um was able to close on the property. We got one more portion of that agreement and then I will send that to you guys. But we were able to acquire 443. [3:22:13, 3:22:14]: Uh M L K. [3:22:14, 3:22:22]: Um, and that'll add to the entrance of Memorial Park,'cause most folks, including myself for years, did not know how to get to that park. [3:22:22, 3:22:42]: Um, because you had to go through the neighborhood to get there. So having that access point off of MLK in conjunction with the next thing, which is our trail systems, and you guys have some of you guys have been on the meetings with the Path Foundation and what they're proposing to connect with the system that we're putting in place with the improvements we're putting in place in the Tide Street neighborhood. [3:22:42, 3:23:02]: Um and Memorial Park had that with link between there and down um downtown. So our trail system and now with the fact that we've got this plus, those you see those things going forward. Um North Hendry Pedestrian Bridge, we're actually now talking with G Dot and our feds on that one. Continue water and sewer upgrades and continuing with um [3:23:02, 3:23:05]: maintenance for um facilities. [3:23:13, 3:23:27]: Charles I say I'm gonna skip through, you know, you guys know we've talked about the challenges um at our retreat back in August. We talked a little bit about some of the challenges that are upcoming and and how we're gonna meet those challenges moving forward. [3:23:27, 3:23:41]: Um and those include obviously growth, growth in our continued growth in um what's happening in the police, public works and some of our other um departments to inlign ourselves with what's happening um with the growth in the city. [3:23:43, 3:23:54]: All right. Uh general fund budget as well as our total budget uh balance. Remember that your budget is predicated on what you propose in revenues, not expenses. So you you [3:23:54, 3:23:58]: You are you estimate what your revenues are gonna be and you [3:23:58, 3:24:13]: make your expenses meet those. Uh so revenues and expenses aligned at twenty nine point two million overall to include our SPLOSS and all the other projects, uh 62 million overall funds, uh enterprise funds, which is our water sewer. [3:24:13, 3:24:16]: stormwater infrastructure uh sixty two point one million. [3:24:17, 3:24:18]: And that's not akin. [3:24:18, 3:24:23]: Far away from cities of our size is pretty much in in line with. [3:24:23, 3:24:27]: Um some cities our size and obviously some cities our size have more. [3:24:28, 3:24:29]: So give an example. [3:24:30, 3:24:32]: The city of East Point where I work is the same population. [3:24:33, 3:24:35]: Their budget is almost two million, two hundred million. [3:24:36, 3:24:37]: But that's because they have electric. [3:24:38, 3:24:44]: uh infr they have electric infrastructure and electric utility as well as they still do uh sanitation. [3:24:48, 3:24:57]: And so to take us back a little bit, uh I I wanted to make sure I remember, you know, we started this process back in at the staff level back in May of this year. [3:24:58, 3:24:59]: Where the staff meant. [3:24:59, 3:25:10]: work through with each of the departments to come up with a budget. That budget was sent to you guys back in uh either late July or early um February early August. [3:25:10, 3:25:15]: We did meet at our budget retreat. Um at that retreat, you had each of the departments come through. [3:25:15, 3:25:18]: go over their budget, you guys were able to ask questions. [3:25:18, 3:25:25]: I think one of the key areas that of concern that came up was events. I think they were at eight hundred thousand and now they're down to six hundred and seventy. [3:25:26, 3:25:27]: And as part of that discussion. [3:25:28, 3:25:31]: With the events department, we uh ax for clarity. [3:25:32, 3:25:52]: as it relates to how Evans is gonna book for those three or four concerts that they put on and what type of acts. And I guess you guys remember me talking about grits and jelly beans. I remember that, that group. Right? Grits and jelly butter. G grits excuse me, grits and jelly butter. I keep keep forgetting. Um [3:25:52, 3:26:02]: But you know, remember reminding that you know, those are the type of acts that that we wanna get in those cover bands versus paying the high costs and be able to bring that budget down. Uh [3:26:03, 3:26:04]: And so we had to first read [3:26:05, 3:26:17]: Obviously after that meeting, uh we had the first read uh back on November twelfth and today we have the second read and if it's clear on the adoption thereof and other than I got some questions. [3:26:31, 3:26:51]: I did get some questions. Thanks you, Count Councilmember Thomas, as promised. Um, you did send me your list of questions and we will incorporate these as part of the appendix in the budget. So you when we've when it's adopted, we'll put it in the back so folks can go through and see what questions to were asked. Um, but we were able to effort m all of your questions. I did send the email this afternoon. [3:26:51, 3:27:08]: after you sent it to us, but I also have a printout for you as well. So um if you have any further questions from there, um we'll be able to answer those as well moving forward. Uh and so with that, you know, like I said, we wasn't gonna go into the weeds. Obviously we've been in this process for the last eight months. [3:27:08, 3:27:16]: Um since May. But if there are any additional questions, obviously we're here to to answer those questions as best we can. And if we have to. [3:27:16, 3:27:17]: Um [3:27:18, 3:27:24]: And if it's, you know, the will of the council will move forward with adoption that's fine. If not, we do have our meeting next week. [3:27:24, 3:27:27]: And we'll try to get those questions and concerns answered. [3:27:27, 3:27:34]: uh make any changes necessary and have it back on the agenda for next week. But we're required by law to have two public hearings. [3:27:34, 3:27:37]: Uh we had one in November, this one and then the adoption. [3:27:37, 3:27:40]: Um that adoption could be at this meeting by law. [3:27:40, 3:27:42]: Um or [3:27:42, 3:27:47]: I think we were used to doing the process of another meeting, but it's actually not required by law to do so. [3:27:48, 3:27:53]: Um, I'm gonna stop because obviously you guys have disinformation, so [3:27:53, 3:28:02]: Um, with that I'm willing to take any questions you may have and we will post all of these presentations online so the citizens can see them under the FY twenty five budget. [3:28:03, 3:28:10]: Councilman questions that she have for Mr. Gardner right now. This is a public hearing, so I gotta open that up as well. But I'll wait and see what kind of questions the council have right now. [3:28:11, 3:28:14]: I think there are a couple of things that I want to ask about this. [3:28:20, 3:28:40]: In addition, uh you've done the budget here, but there was a couple of questions that I had about some items uh that might be of interest to the council in addition to what you have done here. Um in terms of I don't know whether we might s pursue some additional funding and grants or other [3:28:40, 3:28:47]: uh type of assistance but uh if we wanted to have some type of um [3:28:49, 3:29:09]: housing assistance money for someone uh you know we have a lot of challenges in the area that we would be able to provide some type of uh assistance to individuals who were in distress or some uh additional funding that we might be able to provide to uh [3:29:09, 3:29:24]: actually help homeowners become first-time buyers or be able to purchase a home. Those type of uh developments or that type of funding and where we might actually be able to secure that. [3:29:24, 3:29:27]: Yes. So Henry County [3:29:27, 3:29:32]: А за муніципаліті мін Сит Сток, а за муніципалі і Хенри Коті. [3:29:32, 3:29:52]: If you are low to moderate income and you can meet all the requirements, they actually provide first time home buyer assistance for either closing costs, um, or down payment assistance um for homeowners uh to qualify from. And the county get that, that's through the C D B G program um to allow for them to be able to get those. [3:29:52, 3:30:12]: So they can contact the Henry County Community Development Department and they will work with them to facilitate them getting to um being able to acquire those those funds for first-time home buyers as as part of that program. Well I certainly was aware of that. I just, you know, I didn't know whether that covered the cities or not. [3:30:12, 3:30:31]: Normally that covers only uncor unincorporated. So do we have to do something to act upon that? Or is just the whole citizen would go, apply for the funding, and then they would be available to them in the city limits. That is correct. So C D B G, and just to let you know, most of your qualified [3:30:31, 3:30:33]: Areas for [3:30:33, 3:30:44]: Um, will probably be those homes within the cities because if you try to find a home that's affordable for a person in the load and mortar income range, you're not gonna find them out in Kellytown. [3:30:44, 3:30:45]: That ain't gonna happen. [3:30:46, 3:31:06]: Um so most of your municipalities is where you're gonna see those assistance go, whether it's Hampton, McDonough, or Locus Grove or here. I saw them do the presentation. I didn't know it applied to the cities though. It does. And the rate, the affordable now goes up to two hundred and sixty. [3:31:05, 3:31:25]: 75,000. I'm not exactly sure how affordable that is, but certainly it should be to help someone to a cute secure house. And also, we were just at the Eagles Landing Dance Academy, and we certainly understand the effectiveness of the business assistance program, right, May? [3:31:25, 3:31:45]: We were there for that. Absolutely we were there. Right. So we want to be able to s what do we do to uh I know we took some of those out of ARPA and stuff like that. So how do we uh implement or keep supporting local businesses, especially in the downtown area, to be able to bring them in with some of that business assistance or bricks? [3:31:45, 3:31:51]: program that we have. What do what do we do to re f w to replenish those funds that have been depleted? [3:31:51, 3:32:05]: So as it relates to we did use ARPA for a major portion of that the the a business assistance program um under uh Mr. Alance when he was here. Um we did have a small portion of that that we funded through the [3:32:06, 3:32:07]: Um city. [3:32:07, 3:32:27]: Um, as part of the economic development side, I will tell you that they'll we we have our DDA in the downtown area that can do a little bit more. We've talked somewhat about what they can bring in terms of the monies that they've gotten already. And then how do we leverage them to get funding through the State Department of Community Affairs and Economics? [3:32:27, 3:32:47]: Economic development. Um, I think Ms. Um Mr. Jarrell comes with that unique skill in being able to bring that to bear. You know, so far we've gotten 500,000 through the DDRLF program for one business downtown. Um, that's not a is not a cap on how many businesses in our downtown area can get that. As we get new business. [3:32:47, 3:32:48]: This is in [3:32:48, 3:33:05]: we can actually make those applications through the DDA. It's a pass-through through the city to the D from DCA through the city to the DDA to those entities to make those happen. So the it's just taking advantage of some of the existing resources that out here because as a city [3:33:06, 3:33:26]: Stockwridge has not really taken advantage of a lot of the state funding programs. And so we want to make sure that we actively get involved in doing that. As you know, you know, part of what we have now with the TAD is going to be a big deal. And one of the things that we can use some of those fundings for. [3:33:26, 3:33:40]: as we start to get development down here and increase that value is down payment assistance to allow for affordability, right? That's one of the things we can. Business assistance. The city of Atlanta does that all the time through Invest Atlanta. [3:33:40, 3:34:00]: Right. They take those TAD funds and they roll those TAD funds in and they leverage those TAD funds uh in some areas. So some of the same um methods we can take advantage of, and I think we should. I think now we're in a process where we can start doing that as we have development come online here. So yeah, we'll continue to to leverage. [3:34:00, 3:34:03]: Um, [3:34:03, 3:34:22]: You know, I think we have some monies in the budget with as it relates to the D DA again. I think they're over two hundred thousand dollars pretty much with funding coming this year on what they can do to assist with providing some of those programs. So you're not wholly putting it on the city, but allowing the D D A to take some some of that punch as well. [3:34:22, 3:34:42]: Absolutely. So you and our new economic development director will be at the meeting tomorrow night so we can hit the ground running on that'cause I think we hit a a stopping block when we lost our other executive uh economic development director'cause we need to hit the road. Well, we certainly well I mean you already [3:34:42, 3:35:01]: And somebody have to do a lot. You are very busy and somebody gotta do the leg work. So you gotta point man to actually do the work on the opportunity zone. Right. Opportunity zone, opportunity zone, opportunity zone. Yep, we're working on that as well. And if you guys don't know, the opportunity zone is dup job tax credits. [3:35:01, 3:35:04]: So if you create a new job and hold that job for a year. [3:35:04, 3:35:09]: Each business per employee could get up to thirty two thousand dollars per employee. [3:35:10, 3:35:14]: That they don't have to pay to the state, they can use those money to push back into their business. [3:35:15, 3:35:35]: to either increase advertising or do in increase business activity, but they don't have to pay that money and income tax towards the state for those employees. So that's a huge that's a huge win. And we're working on that application we may remain again with the state. We've got the application probably halfway done. GIS is working to put the maps together so we can [3:35:35, 3:35:38]: we could determine where the designated area is and we think we'll downtown is gonna be in that loop. [3:35:39, 3:35:59]: So we know businesses seek out that designation and it'll uh uh put pinpoint where we need to uh go there. And then finally, it may be seemed to be trivial, okay, but I can't tell you how many compliments that we've gotten on the Christmas decorations or holiday decorations. [3:35:59, 3:36:19]: At Eagles Landing at the monument there and even in downtown. I think the desire was for us to continue to move forward with that. I think Walt Stevens was supposed to be coming up. Certainly I would like to see Jodico put on the list and some other areas. And as we're talking about it, it can't just be taught. [3:36:19, 3:36:39]: It's gotta be funded. So in order for it to be funded, it has to go in the budget. So I like to see what we can do about expanding that program because man, I tell you, that thing has gone viral with so many people talking about all the Christmas lights, all the holiday lights that we have. And I like to say Christmas, I'm sorry, it's me. [3:36:39, 3:36:59]: Me, uh, my personal opinion, is that people love to see that. It's brought so much joy. And if we could find a few extra dollars in the budget to be able to expand that, especially uh in Jodico, where we have uh, which will probably soon be our number one commercial area with the businesses that we attract in there. So [3:36:59, 3:37:10]: So whatever we can do to crunch some numbers to find a few extra dollars for a tree or some lights, especially at this holiday season, that would be great. And that concludes my comments. [3:37:10, 3:37:20]: Diddle. Uh well and real quick, and I know there was some some stuff sent on on social media about the trees at the [3:37:20, 3:37:21]: Uh the tower. [3:37:22, 3:37:30]: Um,'cause I actually got the email from I got a text from Henry County Chief of Police that said, Hey, your lights are not working. [3:37:30, 3:37:33]: Um literally what it was the lights are working. [3:37:34, 3:37:37]: I said I want everybody to know there was nothing wrong with the tree. The issue was [3:37:37, 3:37:41]: We were using up all of the plugs in the towel. [3:37:41, 3:37:44]: to light it and the homeless folks were coming and unplugging'em. [3:37:46, 3:38:06]: So that's was the issue. And so what we did was just pretty much reduce the usage of the outlets to four and allow for them to plug in whether they're plugging in small heaters when they're out there late at night or whatever, or whatever they're plugging in, um, we wa we allow for those we give them eight. [3:38:06, 3:38:07]: Of the eight. [3:38:07, 3:38:10]: Um, sockets there, we freed up four of'em. [3:38:11, 3:38:31]: Uh but that's what that's what the issue was. So if you guys got those text messages or saw those complaints, the lights, all of the lights on all of the the trees, the um the wreaths and all of the little associated accessories, they all work. It will be put up. I never saw that. All I saw was a lot of compliments. [3:38:31, 3:38:41]: About how to love it. So you know. We take we make sure that that's that's known that it wasn't that we were putting up faulty stuff. It was the homeless folks unplugging it. [3:38:43, 3:39:03]: All the good ideas and in reference to assisting and the citizens in the c uh community, some of those things can you yeah, can they be posted on our website informational to help our folks? In terms of of you know you're talking about links from Henry from Henry County to those. [3:39:03, 3:39:23]: tag into them and of course obviously you'll be working with the DDA along with the Cosmo and Alexander, things that nature as well. But uh just thinking about the information needs to be out there so they can look at it, see it, and make some actions, make some moves here. Um this is our second reading. So I I thought that uh we had to do uh three readings which [3:39:23, 3:39:30]: This is be December seventeenth, I would think. Uh next week. I'm sorry. Ms. Barber has a question. All right, Miss Barber, go ahead, please. [3:39:32, 3:39:37]: Mr. Gardner, I don't see any funding proposed for land acquisitions. [3:39:39, 3:39:40]: Since boss. [3:39:40, 3:39:41]: Uh uh. [3:39:41, 3:39:43]: Is there a reason why not? [3:39:43, 3:39:45]: No ma'am. Um [3:39:45, 3:39:54]: Uh uh no no line has been identified by council for us to purchase. I think since I've been here, I think the only one we purchase has been [3:39:55, 3:40:03]: the one we did recently. Um so that's not a you know, if if we have to, we obviously we'll have to look for funding if that comes about. But [3:40:04, 3:40:21]: you know, in our discussions and stuff for the retreat that never came up about land land purchase. There have been references to our visit to Sandy Springs. Um and we talked about how they were able to redevelop their downtown area. And that was one of the things that they did. [3:40:22, 3:40:38]: Correct that they can control correct zoning and developments in the area. Correct. I like to see us add a budget for land acquisitions here. And I will say, um council coun councilmember Barber. [3:40:39, 3:40:50]: Unlike Sandy Springs, we've actually owned a lot of our properties around here. I mean, the the the prime ones that we want for development, the three-acre site right behind you guys. [3:40:50, 3:41:02]: you know, maximizing the existing parking lot and subsidizing those parkings to a parking deck versus that all surface parking and capitalizing on that. Um the fifteen acre site here. [3:41:02, 3:41:07]: The we owned between Fletcher's and I forget the [3:41:07, 3:41:10]: The other building on the far end next to Love Street and Burke Street. [3:41:10, 3:41:13]: That vacant track in there, remember, we actually own those. [3:41:14, 3:41:29]: Um, we're at a parking lot where we just redid and restriped the parking lot. So all of that is up for future development. So unlike for Sandy Springs, I mean, we're we're kinda in the catbird seat to some degree to to get development. And and I will tell you, and I you guys heard me mention this. [3:41:30, 3:41:31]: If we get [3:41:32, 3:41:34]: The three acer site down here develop. [3:41:35, 3:41:43]: The amount of synergy that that's gonna put on the whole downtown area is gonna be key in terms of especially our tracks on the other side of Burke. [3:41:43, 3:41:45]: Um wood'll help that too. [3:41:45, 3:41:54]: is if we put in our activity, the youth performing art, whatever one the council puts in there right now, we've got the performing arts, cultural performing arts going in there. [3:41:54, 3:41:59]: You know, that's gonna be a huge thing and especially we're able to leverage that with the [3:41:59, 3:42:02]: Uton senior is one one project. [3:42:02, 3:42:07]: Because if you think about it right now, the number one thing that's missing downtown is people. [3:42:08, 3:42:10]: Рай, вига фізнес. [3:42:10, 3:42:11]: But [3:42:11, 3:42:13]: The key is as we start to develop. [3:42:14, 3:42:17]: And you have that activity center there, reg if it's boat or one. [3:42:18, 3:42:27]: Right. When they're in use, people are gonna come out, especially if you got something where kids are moving about. So now you've got potential for smoothie sharp, ice cream sharp. [3:42:27, 3:42:28]: You know [3:42:28, 3:42:33]: Those type of of re small ref restaurant type activities in the downtown area. [3:42:33, 3:42:34]: Um [3:42:34, 3:42:44]: You know, that's where we get our friends from Carver and the rest of these guys that we've been talking to, right? As soon as we bring them here, the first thing they do is they want to look out there, right?'Cause that's where the activity is. [3:42:45, 3:42:48]: But as soon as you start see building coming here, guess what's gonna happen? [3:42:48, 3:43:08]: Those same entities or similar entities gonna wanna come downtown. And especially if you can prove to them that the foot traffic is there. Um, that's gonna be the key to get that going. So yeah, we we're kinda in a different situation where we've got some land ripe for development, for private development. So you'll see that happening. I I'd much rather for us to control it all so that we don't get [3:43:08, 3:43:13]: I'd much rather for us to control it all. Yes. So that we don't get [3:43:15, 3:43:24]: Purchases such as package stores, such as oh oh no storage facilities. No. Those kinds of things that are already zoned. [3:43:25, 3:43:33]: I want us to be able to control it. And the only way we can control it is if we own it. There are still some areas along North Henry. [3:43:34, 3:43:44]: There may be opportunities and I just want us to and ready. Oh well. So thank you, sir. You're welcome. [3:43:46, 3:43:47]: They didn't do that for space. [3:43:48, 3:44:08]: This is supposed to be a public hearing as well, so let me open that up. Uh comments uh for the uh the budget uh thus far, any positive comments? Anybody from my far left side? Anyone in the middle, my far right side? Any negative comments in reference to the public hearing, pub public uh budget for twenty [3:44:08, 3:44:17]: 2025, the far left side, thing in the middle, and for the right. Okay. No comments one way or the other, so I'll close that portion out. Um [3:44:18, 3:44:38]: This is uh earlier in the conversation um Mr. Gardner you're talking about uh requirement is two potentially three, I guess I was thinking three uh actual bubble hearings and uh and adopted at the end of the third one. Um unless that's up to desire of the of the council to to do this tonight. I know there's some questions here that you answer. I don't know if we need to. [3:44:38, 3:44:46]: I still have um I still owe Mr. Thomas um one one answer. I think I still owe him one. Okay. Um [3:44:47, 3:44:54]: And yep. That's the one with the job descriptions and stuff. So I still owe him that to get that to to you guys. So [3:44:54, 3:45:14]: Staff started working on that this afternoon. So obviously we couldn't get all of that done today. Um so if he if if he wants, we can We can have the we can have the uh final reading and adoption on the seventeenth. [3:45:15, 3:45:16]: Mr. Go ahead please. [3:45:17, 3:45:37]: Well, Mr. Garden, I do appreciate you responding. Um I may not agree with all of the answers. Uh I think a lot of some of this is in the control of the councils for some decisions of you know policies and procedures of [3:45:37, 3:45:50]: approvement of job description, et cetera, et cetera. I I think that's in the in the wheelhouse of the council. So I disagree with some of your answers, but tonight is not tonight. [3:45:51, 3:45:52]: Um [3:45:52, 3:45:57]: One thing I do wanna mention and I know Councilman Alexander and I had this issue. [3:45:58, 3:46:01]: uh discussion and you mentioned it tonight too. [3:46:02, 3:46:18]: about the youth and senior, about the uh performing arts, and I think um some of us do agree that it need to be separated because you know when we start talking capacity [3:46:19, 3:46:22]: And we see issues that we have now. [3:46:23, 3:46:26]: uh with capacity [3:46:27, 3:46:29]: in some of our venues right now. [3:46:30, 3:46:32]: That's right. [3:46:33, 3:46:35]: I don't wanna rush through [3:46:36, 3:46:40]: And I do understand about uh approving a budget. [3:46:42, 3:46:44]: And I just want to say this to the council. [3:46:45, 3:46:48]: If you go into twenty twenty five [3:46:49, 3:46:50]: Without [3:46:51, 3:46:54]: An approved budget. [3:46:55, 3:47:00]: It just carries over to what it was in twenty twenty four. It's not the end of the world. [3:47:01, 3:47:02]: But what I'm saying is [3:47:03, 3:47:04]: I want to get it right. [3:47:05, 3:47:15]: When we talked about code enforcement, public safety, um, public works, [3:47:15, 3:47:18]: See those things are very important. [3:47:18, 3:47:20]: And we have to get it right. [3:47:21, 3:47:23]: And I don't want to gloss over [3:47:24, 3:47:25]: these issues because [3:47:26, 3:47:28]: The proof of the puddin is what you do. [3:47:29, 3:47:31]: And I've seen [3:47:31, 3:47:34]: What is happening, especially with code enforcement. [3:47:35, 3:47:37]: Unless [3:47:38, 3:47:40]: Something is gonna change. [3:47:41, 3:47:46]: As far as the way it is managed and the way staff is going out. [3:47:47, 3:47:49]: then it's it's the same. [3:47:50, 3:47:51]: So [3:47:52, 3:47:54]: I want to continue the conversations. [3:47:55, 3:47:59]: And and what sorta disturbed me somewhat too is [3:47:59, 3:48:01]: And as you all know in the council know. [3:48:02, 3:48:04]: Did I respond to the budget every year? [3:48:05, 3:48:13]: And I know we have our treasure back, and I would love for for him to come up and just say some words, but this is the framework. [3:48:15, 3:48:30]: of how we run the operations of the city. And I and I don't take this lightly. And I think we have to get it right. Then if it's not right, we come back and we make the amendments and make the changes to get it right. [3:48:31, 3:48:33]: Oh this whole process of this budget. [3:48:34, 3:48:35]: And how we [3:48:36, 3:48:37]: ефективні [3:48:38, 3:48:40]: А не фішенли [3:48:40, 3:48:42]: Runs this city. [3:48:42, 3:48:44]: It's very important to me. [3:48:44, 3:48:49]: And sometime I think we just sort of just gloss over this process. [3:48:49, 3:48:52]: And I tell citizen all the time. [3:48:52, 3:48:54]: When we have two readings or three [3:48:55, 3:48:57]: And none of you come up here, citizens. [3:48:58, 3:48:58]: So [3:48:59, 3:49:00]: Don't come later. [3:49:01, 3:49:02]: After the fact. [3:49:04, 3:49:07]: You have your opportunity to come in now. [3:49:08, 3:49:11]: to speak to that, but but I'm speaking to my counsel. [3:49:11, 3:49:13]: Let's not gloss over this process. [3:49:14, 3:49:23]: This is the framework. And that we and we we talked to these gentlemen earlier about the future and where we're trying to go. [3:49:24, 3:49:26]: Діс фреймворк, дис документ. [3:49:27, 3:49:28]: It is about the future. [3:49:29, 3:49:31]: And we have to get it right. [3:49:32, 3:49:35]: So we're going to be effective and efficient. [3:49:36, 3:49:37]: Every day [3:49:38, 3:49:43]: Of staff carrying out the vision and goals. [3:49:43, 3:49:45]: We have to get it right. [3:49:45, 3:49:49]: And staff have to understand when they come to work [3:49:50, 3:50:02]: their mission. And you know, you know, I'm a football player, I know you're an athlete. And we sort of see now, you know, how these teams are sort of failing, some are successful. [3:50:03, 3:50:05]: And it's all because [3:50:05, 3:50:18]: You have different folks that take their job a little bit more seriously and they prepare and they work hard and therefore they are successful. Some teams are successful every year. [3:50:18, 3:50:21]: And some are not Latin Falcons. [3:50:23, 3:50:42]: But uh you gotta leave the Falcon saloon, sir. Okay. I love my Falcons, but I'm telling you. It's tough. They they beat you up and let you down. It's tough. But my point is I and I just don't want us to take this process lightly. Understood. And and I don't have a problem with [3:50:42, 3:50:44]: Agreeing to disagree. [3:50:44, 3:50:48]: 'Cause the bottom line is let's just get it right. That's true. [3:50:48, 3:50:51]: And and staff, let's understand. [3:50:51, 3:50:55]: That when we create the vision and the mission. [3:50:55, 3:50:57]: It's a collaborative effort. [3:50:58, 3:51:06]: And at the end of the day, whatever that is, let's go out and try to be successful at it. And then and it's nothing wrong with coming back. [3:51:07, 3:51:11]: to make adjustments and amendment to that. Correct. [3:51:11, 3:51:17]: But I don't wanna just sit up here and nobody says nothing. Understood. And that's why sometimes [3:51:17, 3:51:19]: I will say something sometime I don't. [3:51:20, 3:51:28]: But I I want I want my councilmates to hey, let's get into this framework. Say something, ask some questions. [3:51:29, 3:51:30]: Let's get it right. [3:51:31, 3:51:35]: I don't want us two and three months down the road complaining. [3:51:36, 3:51:37]: About something. [3:51:38, 3:51:48]: When the time is now we're in that cycle. We go have these retreats. We come and have three readings. We have opportunity to call you up, send you an email. [3:51:48, 3:51:50]: So I'm just saying. [3:51:50, 3:51:51]: You know. [3:51:52, 3:51:53]: Let's do [3:51:54, 3:51:57]: What the citizens elected us to do. [3:51:58, 3:52:01]: And take our responsibility a little bit more seriously. [3:52:02, 3:52:03]: And yet do the job. [3:52:04, 3:52:22]: So that that's all I have to say. So you'll hear more from me. As I mentioned, I have some other, but you know, we get caught up and I know we got a time frame and I don't want to bombard you with all that at the very last minute. Understood. But I do have other concerns and questions. [3:52:23, 3:52:25]: But I don't want to be the only one [3:52:27, 3:52:28]: Asking questions. [3:52:28, 3:52:30]: Making recommendations. [3:52:31, 3:52:48]: Yes, sir. And and and Mr. Thomas and and thank you, right? Um, you know, we always say your your any budget is is not the Bible and or the Constitution, right? Those are usually hard fast documents that we don't change. [3:52:48, 3:53:08]: Right. We know that the budget is fluid because as we talk about the economic impacts, things that are coming out of the blue that you don't see and you have to make you know, you have to look at things um from that standpoint. I I will say thank you to council. Um and when we talk about the team and the effort, when we sat down and we went through the strategic planning. [3:53:08, 3:53:28]: process um la uh a few years ago. Um and we're looking at that now and saying, hey, okay, what are we being doing? Because one of the things I w really want to get to is, you know, when we get to that first retreat and then to that budget retreat, that we're looking at stuff strategically as it relates to that vision. [3:53:28, 3:53:33]: Right. We have a twenty-year vision under the comprehensive plan. That's a twenty-year document. [3:53:34, 3:53:37]: But guess what happens in twenty years? Twenty years ago [3:53:37, 3:53:39]: It was two thousand and four. [3:53:39, 3:53:41]: What happened in two thousand and eight? [3:53:42, 3:53:43]: Two thousand and ten. [3:53:44, 3:53:49]: Impacted that back half of that vision, right? Because we went into a recession. [3:53:50, 3:53:53]: People lost their jobs, their houses, their business. [3:53:53, 3:53:54]: Right. [3:53:54, 3:53:56]: And so what that plan envisioned. [3:53:57, 3:54:00]: Had to come had to come back and change because [3:54:00, 3:54:11]: In two thousand four when that was done, it never envisioned that that economic impact. So yes. So but let me just say this also, but one thing I've learned over the years [3:54:12, 3:54:14]: When you look at the goalposts. [3:54:16, 3:54:18]: The goalpost is not stationary. [3:54:20, 3:54:24]: Every time you turn your head and you look back at the goalpost. [3:54:24, 3:54:27]: The goalpost has moved. [3:54:28, 3:54:32]: So we have to move with that. We have to adjust every day. [3:54:32, 3:54:34]: In order to do that. [3:54:34, 3:54:41]: But we have to be about doing that. Yes, sir. And so if you don't mind, uh [3:54:41, 3:54:46]: My treasurer back there. I I came to see him one day but he was busy, so [3:54:46, 3:54:49]: Uh and ten and the reason I say this because [3:54:50, 3:54:52]: Whatever this council approved. [3:54:54, 3:54:56]: Staff has to carry that out. [3:54:56, 3:54:58]: And that's why it's important. [3:54:59, 3:55:03]: For our children, he just been here a week or so. [3:55:04, 3:55:10]: But you know, you have to hit the ground running. And seeing just like we mentioned to those gentlemen that was here earlier. [3:55:10, 3:55:15]: And I know some of us that been here for a while, we put a lot of work in [3:55:16, 3:55:32]: The land use planning, the strategic planning. Over these last ten years, you know, we have put a lot of work into that to try to create when you look at the land use, you see all these different colors. Yeah, of course some of that is gonna change, yes. [3:55:33, 3:55:35]: But it's important. [3:55:35, 3:55:38]: For us to do that because this is the framework. [3:55:39, 3:55:41]: that we're doing and so when we designate [3:55:42, 3:55:49]: the whole city when we designate the land use, we put a lot into that based on a vision. [3:55:49, 3:55:54]: Now yeah, that does change. But what gets me sometime when [3:55:54, 3:55:58]: We come up here every month and we're changing. [3:55:59, 3:56:03]: You know, uh is it necessary? But and maybe so. [3:56:04, 3:56:06]: And that's when I asked uh Mr. Anderson here. [3:56:06, 3:56:09]: So when are we going to look back at [3:56:10, 3:56:11]: The the document [3:56:12, 3:56:32]: To try to make changes based on the future of what we think is the future, what we project. But no one else ever crystal ball. We don't know what tomorrow is gonna be. Yes. But we have to do the best we can. Yes. But anyway, I know it's late and tonight is Monday night football. But uh our treasurer. I just want him just to [3:56:32, 3:56:37]: You know, because we're going to come let me just say this,'cause we're going to hold him accountable. [3:56:38, 3:56:40]: To carry out some of this stuff. [3:56:42, 3:56:44]: And so I just want him to get to accustom [3:56:46, 3:56:48]: Mr. Garney, so [3:56:48, 3:57:00]: I know you're in the line of fire all the time, Mr. Garner. So I just want him to get used to being in the line of fire. Yes, sir. Because uh, you know, when you come. [3:57:00, 3:57:10]: It's it's the nature of the beast. Yes sir. Because hey, cause we're about trying to get this thing right. And that's why we're the envy. We're the envy of George Stockbridge. [3:57:11, 3:57:14]: We're the envy because of what? Because we work. [3:57:15, 3:57:18]: These folks up here we're dedicated to get it done. [3:57:18, 3:57:22]: So when we you know we got a new uh teammate. [3:57:23, 3:57:29]: So get in the line of fire and uh you know, my grandmama say, step up, be a man, take your little spanking. [3:57:30, 3:57:50]: Go here, sir. So the budget is a promise that you are promising the citizen this is what we are going to do. Strategic planning is the one that you make in 20 years, as he has said, in 20 years, 10 years. But in local government, that 10 years is done yearly. [3:57:50, 3:58:06]: And even you say five years capital project is not done five years, you see you adjust year after year, because we can only fund one year. So this is a promise. But you are having a living document. [3:58:06, 3:58:26]: What you have approved, you are approving today, or you are going to approve it, adopt it on the seventeenth, we have budget amendments. Amendments are done, you have more revenues as you projected, you have to make amendments. Or expenses are more than revenue, you have to make amendments. [3:58:26, 3:58:35]: Things that you have done or that we planned from August, went to the retreat up to now may change in two years, three years. [3:58:35, 3:58:38]: А пріоритети з меч. [3:58:38, 3:58:41]: So what we may not do. [3:58:42, 3:58:47]: On the seventeenth when I adopt the budget, we can always do that in January, February until. [3:58:47, 3:59:07]: Remember it's an ongoing. We finish as we are with it. We will start another budget for 2026. So planning is the most important thing and that is to be accomplished with the promise that you make through the budget. This is what we are going to do for you the citizen. [3:59:12, 3:59:13]: The one you may have loves walk you. [3:59:15, 3:59:16]: Thank you, sir. [3:59:16, 3:59:18]: Miss Ms. Gett. [3:59:18, 3:59:26]: Thank you. Um in regards to the I saw some of the questions that Councilman Thomas had and that they're your response. Uh [3:59:26, 3:59:32]: I'd would like to take under advisement what our new financial director. [3:59:32, 3:59:52]: opinion is of open.gov and and whether or not it reads with our ENCODE system and all the other platform stuff and and the pros and cons of that. And so I I would, you know, after and the reason I say that is because um um I can't discuss executive session, but w we [3:59:52, 4:00:12]: Did an interview process. We talked a little bit more so about different platforms and the challenges of different platforms. So I will like to take his advisement on whether or not that is something that's gonna be beneficial to us or whether or not it could it gives us a headache. And that's something I'm just pointing out based off [4:00:12, 4:00:22]: off of what I read and some of the questions that Councilman Thomas um had produced. Also in regards to um [4:00:24, 4:00:40]: The budget there I look forward to hearing more about the n, you know, the the name changes of different positions and titles. Um that is something that definitely I'm looking into more. So um [4:00:40, 4:00:48]: And and so I'm gonna add I I too would like to know detailed information in that regard. And [4:00:49, 4:00:54]: Um we mention and talk Councilman Alexander, even though it's not really [4:00:55, 4:01:04]: A part of the budget, and we talked about grants. Um, and this is just some information for mayor and council to discuss and think about in the future as well. [4:01:04, 4:01:12]: Um what I'm seeing and what I'm gonna suggest, and it really doesn't have anything to do with the budget, but we talked about this already. It sounds like [4:01:13, 4:01:13]: Um [4:01:14, 4:01:34]: We need to maybe get with Miss Valerie Ross a little bit more and get our codes, our get everything all the way up to date instead of having all those e extra conditions and some other things that we might need to take into consideration. I'm thinking that that that is something that we need to [4:01:34, 4:01:54]: um go into detail with. And I think she can also give us some better ideas of whether we do a study on how many storage facilities we need, how many this we need, and so that we can have a better picture of the needs of our community in the future. And we can both [4:01:54, 4:01:55]: budget accordingly. [4:01:56, 4:02:16]: Um, not just on a comprehensive plan scale, but just like we want to we do studies of shopping centers and everything else, I think that it'd be feasible for us to see what those kind of so not so desirables would be and where the perfect locations for them would be. Um [4:02:16, 4:02:36]: in general and what they should look like. And from my understanding, um in the real estate world, Valerie Ross is a woman to be able to do that and put a packet together for us for that. So those challenges that we have and the long-winded the conversations that we have up here, we can streamline and make real nice and neat. And I think we should utilize her a little bit more for [4:02:36, 4:02:48]: for that purpose. And and lastly, um we also need and so that's something that I would like for us to think about and include. [4:02:48, 4:02:53]: um in our budget. And I also would like to see um [4:02:53, 4:03:08]: uh you know, we deal with legal a lot. I would like to see uh itemization on that, if you can bring that to m and show me their billing for this year monthly. Um and I do [4:03:14, 4:03:19]: It was one more and I can't find it. Um [4:03:20, 4:03:27]: As of now, I th I think that's it. But I really want to take into account I know you're new. [4:03:27, 4:03:27]: Um [4:03:28, 4:03:30]: But I I want to take into account [4:03:31, 4:03:32]: Um [4:03:32, 4:03:41]: our financial director position on that, on on where we're headed with this and and what we can do to streamline. And that's it. [4:03:42, 4:03:43]: Mr. Alzheimer's going, please. [4:03:44, 4:04:04]: Yes, I I wanted to just add uh briefly, ms Councilman Thomas and I certainly have had a discussion that needs to be reflected in the budget about the code enforcement actually moving away from the police department to um community development or its own [4:04:04, 4:04:19]: department such as because you know effectiveness is everything and effectiveness to us means results and those results need to be the community development approves the project. [4:04:20, 4:04:40]: The code enforcement goes out to check to see whether or not they those processes have been adhered to. They interpret the code and whether the person works directly for them. There needs to be better coordination between the two. And right now we just understand the police department should be focused on [4:04:40, 4:05:00]: Crime. They should be focused on crime and they should be focused on uh you know, making sure that they are maximizing those opportunities. And I don't know, it's just been in my past that they they don't look at these violations as saying they're looking for criminal violations. [4:04:59, 4:05:05]: [14705.0, 14725.0]: I am in full support of moving the code enforcement to uh community development or another or their own several department with a director or a senior person who is over that department and that they are to go to the field, not just sit in the office. [4:05:25, 4:05:35]: they work in the field and that they report on results that they are rech achieving because again and again similar items keep being repeated. [4:05:36, 4:05:49]: And just not receiving the results that I would like to see uh on that side. So I certainly want to see um something change uh into that effect. Um also see. [4:05:55, 4:05:59]: I understand in the last couple of years, especially with the election that we saw. [4:05:59, 4:06:19]: Inflation has been a big topic. It's gonna cost more money. So certainly we'd have to look at what we're doing in terms of making sure that we're being as expensive responsible as possible with the dollars that we have. But fortunately for us, we've seen a lot of economic growth that's been able to grow the pie. [4:06:19, 4:06:39]: So we've been able to keep up with a lot of the growths that have been taking place. But um let us make sure that we're focused on uh maximizing uh in each department uh everything that uh that we can and ensuring that we're getting maximum productivity while balance. [4:06:39, 4:06:59]: Seeing. I see that we have a four percent increase, right, for us uh our employees because we do understand that inflation is very relevant in what we're doing. And certainly we did set the minimum wage at fifteen dollars an hour. And I think we might even have to revisit that at some point. [4:06:59, 4:07:09]: because what has really happened is these costs have really gone up and we want to make sure that we're doing everything possible to be a an attractive uh [4:07:10, 4:07:13]: employer uh in the community. Thank you. [4:07:13, 4:07:15]: All right, any other comments? Quite Ms. Bloodman? [4:07:17, 4:07:22]: Mr. Gardner. Yes sir. Um so the events budget. Yes, ma'am. [4:07:23, 4:07:40]: I like to see that reduced even more. Um along with the amphitheater budget. I prefer that stay at the two million. Um I do have a question though, this on the third page of the budget. [4:07:40, 4:07:44]: Looking at the twenty twenty three actuals [4:07:45, 4:07:49]: versus what we adopted in twenty twenty four. [4:07:50, 4:07:53]: Looking at the line for intergovernmental revenue. [4:07:55, 4:07:56]: The actual [4:07:56, 4:07:58]: For twenty twenty three. [4:07:59, 4:08:01]: Shells a million two hundred and twelve. [4:08:01, 4:08:02]: Thousand. [4:08:03, 4:08:04]: I don't know what was budgeted. [4:08:05, 4:08:08]: But looking at what was adopted for twenty twenty four. [4:08:08, 4:08:10]: shows two hundred and twenty eight thousand. [4:08:11, 4:08:13]: There seems to be some discrepancy. [4:08:14, 4:08:18]: And I need to know what the actual was for twenty twenty four. [4:08:19, 4:08:25]: All right. So y you wanna know what the budgeted amount for for twenty twenty three was? [4:08:25, 4:08:28]: Or the actual for twenty twenty four, where we are today. [4:08:30, 4:08:31]: I wanna know. [4:08:31, 4:08:33]: What was the budget? [4:08:34, 4:08:38]: For intergovernmental revenue in twenty twenty three. [4:08:39, 4:08:44]: And I wanna know what the actual was for twenty twenty four. Okay. [4:08:45, 4:08:51]: No problem. I could change the chart and put that in for you. And the same with the line miscellaneous revenue. Yep. [4:08:52, 4:08:54]: For the twenty [4:08:54, 4:09:02]: What I'll do is I'll put I'll put those for each one of those headings so they get to see each each one of those items. I'll change that and and put those in for each one of those so you'll be able to see. [4:09:03, 4:09:08]: that what you're requesting for each for each taxation, for each one of those items, I'll do that for all of them. [4:09:08, 4:09:21]: Thank you. It just looks like a Yes, ma'am. You see what the actual looks like for twenty twenty three? A million dollars, but what we adopted in twenty twenty four is only a couple of hundred thousand. So I don't know. [4:09:22, 4:09:28]: I don't know what to think of that. No problem. I'll explain. Okay, same with the miscellaneous revenue. I'll reflect it. [4:09:28, 4:09:29]: That four million? [4:09:30, 4:09:36]: What was actually spent, but then what we adopted was two hundred and forty four thousand. [4:09:37, 4:09:45]: So those kinds of disc discrepancies kind of throw me off and that just jumped out at me. Um the other thing [4:09:46, 4:09:47]: The [4:09:47, 4:09:53]: management analyst position, that wasn't a position that was discussed during the retreat. [4:09:53, 4:09:54]: Um [4:09:55, 4:09:56]: We didn't discuss. [4:09:56, 4:09:58]: uh re classing [4:09:58, 4:10:00]: A management analyst physician. [4:10:01, 4:10:04]: To a manager of innovation, is that what that is? Yeah. [4:10:05, 4:10:07]: That's a five step pay grade. [4:10:07, 4:10:27]: We won't go all the way to the top of that pay grade, without a doubt. Um and so as I think Councilmember um Thomas said, I what we'll do is explain what what's going on with each where we're reclassing our new positions. We'll m address that with explanations for you guys. Thank you, sir. You're welcome. [4:10:27, 4:10:28]: That was all. [4:10:29, 4:10:30]: Any other comments from the council? [4:10:31, 4:10:51]: Just echoing the same things have been stated earlier. I don't want to kind of beat the dead horse, but uh revising again those position changes and stuff like that, trying to get clarification on that. And then as as well as uh some of the uh things that we discussed as a budget treat and trying to bain maintain the consistency across [4:10:51, 4:11:10]: what we see at at at the end of the year when we're ready to approve it. And so, yeah, that's that's what I wanted to add. Thank you. Okay, so December seventeenth, Tuesday, December seventeenth, third reading and eventual adoption of the FY twenty twenty five Okay. All right. And we'll we'll make all those adjustments and highlight where we made them. So y'all see them. [4:11:11, 4:11:31]: Okay, we're now going to new business. Uh de-annexation case DX two zero two four-zero three for manually subdivision phase three. Consideration of an ordinance to de-annex from the corporate limits of the city of Stockbridge. Nine parcels within the manually subdivision representing phase three. Request was made by the owners of nine parcels which would become part of the unincorporated Henry County. [4:11:30, 4:11:32]: Mr. Anderson, please. [4:11:35, 4:11:55]: And by the way, Ms. Anderson, in this in this process for uh phase three and phase four, in the previous uh discussions, we knew exactly what addresses these were all involved. It doesn't have that at least I don't see them in here. Maybe my maybe I'm maybe I'm blind here today. But we need to talk about what address we're talking about to make sure it's uh rock is [4:11:55, 4:11:58]: continuity and they're all connected. [4:11:58, 4:11:59]: Yeah, yeah [4:12:01, 4:12:05]: Yeah, I'm just gonna keep oh you got a presentation on it. [4:12:05, 4:12:09]: Especially the air to the middle of the kind of water. [4:12:09, 4:12:11]: I went to the house. [4:12:13, 4:12:13]: Thanks. [4:12:14, 4:12:16]: May come back to this later. [4:12:16, 4:12:18]: But I just wanna give him a picture of it. [4:12:22, 4:12:31]: So yeah. Yes, ma'am. Okay, no, okay, so ahead, please. [4:12:39, 4:12:40]: You alright? [4:12:45, 4:12:46]: But it's too late then. [4:12:47, 4:12:50]: I'm saying it's good if you find it. [4:12:54, 4:13:05]: Okay, here's the uh nine properties that that that are a part of phase three and they're and their addresses. Okay. On the screen. If you can't see it I can uh make it larger. [4:13:06, 4:13:10]: No, I can't see it. You can't see it. I mean obviously it was kinda small. Very small. [4:13:13, 4:13:14]: Oh I can say. [4:13:14, 4:13:17]: Not very small, okay. Wait a minute. [4:13:21, 4:13:40]: So this this is on letterhead. Yes. Yes, sir. Okay. So this is phase three, nine properties in phase three. I'm assuming you had a chance to to look at these all on the map themselves and where are located on oh it looks okay. There we go. [4:13:40, 4:13:42]: Oh yeah, I'm gonna do that. Oh [4:13:47, 4:13:51]: Yes, sir. Put it on slideshow for me uh [4:13:51, 4:13:53]: All right. [4:13:54, 4:14:14]: It'd be good uh for this in uh phase three and phase four to at least get a Okay. I mean I'd like to get a copy of this actually. I think it'd be beneficial. Uh'cause it's not in the package, but I'll I'll s we'll send it to you. All right, appreciate it. Tire council needs to receive that, so at least I have it. Yeah, th these are the nine and uh nine properties in uh phase three. [4:14:14, 4:14:21]: presentation I think phase four. Mm-hmm. And that should be the last of uh properties in the subposition. Okay. You better [4:14:23, 4:14:28]: Great. You got more computer skills than me, man. [4:14:29, 4:14:49]: So this guy wants me to read them into the record or you can see that. Yeah, yeah, go ahead and do that, sir. You got 220 Jasper Drive, 230 Jasper Drive, 240 Jasper Drive, 255 Jasper Drive, 224 White Sand Drive. I mean White Sand Bay Drive, 230 White Sand Bay Drive, 231 J. [4:14:49, 4:15:00]: White Sand Bay Drive, 241 White Sand Bay Drive, and 251 White Sand Bay Drive. This is phase three. Okay. Nine properties. [4:15:00, 4:15:02]: All right, Mr. Alexander, you have something, sir? [4:15:03, 4:15:10]: This is all of the properties in the subdivision or are there more properties? Uh, I'm thinking phase three and phase four is the end of it. [4:15:10, 4:15:16]: So it's every last one of the properties? We just did what? [4:15:20, 4:15:40]: We didn't do anything, sir. They choose to want to be able to do that. Did you send them something? I think that meeting was held and explained and did you send them something? I think there was a meeting that was done correct can I [4:15:40, 4:15:50]: Can I speak to that? Yeah. Yeah. So there was a meeting I think held by the district council person with those folks over there and that was highlighted and explained. [4:15:50, 4:15:51]: And so you know [4:15:52, 4:15:53]: Let me say this. I mean [4:15:54, 4:15:56]: They have a right. If they choose to want to go, go. [4:15:57, 4:16:00]: Амінвиканти до дело. [4:16:01, 4:16:02]: Right. Um [4:16:02, 4:16:17]: Overall, do I think it would have been beneficial for them? I think it was highlighted to those homeowners that you actually was getting a tax savings. You were also gonna be able to get an additional tax savings with homestead exemption and they still chose to leave. [4:16:17, 4:16:21]: Right. Um, I'll tell you a little bit more history offline, but [4:16:23, 4:16:27]: I mean, they made the choice to want to be outside the city, that's fine. I mean [4:16:27, 4:16:29]: Dit it's not gonna change the address. [4:16:30, 4:16:32]: They're gonna be one oh five, something. [4:16:32, 4:16:33]: Stockbridge, Georgia. [4:16:34, 4:16:38]: Whether they unincorporate or unincorporated, they can't change that height of it. [4:16:41, 4:16:55]: Homes in there. There was a total of sixty seven. Sixty seven. Sixty seven homes. So all sixty-seven have come before us. Yes, sir. And and so when they started this process, I I think I sat down with the mayor and I mapped out exactly how they were gonna do it. Right, you did sir. [4:16:56, 4:16:57]: Right? Based on the law. [4:16:58, 4:17:01]: Which parcels was gonna come in and win? Because [4:17:01, 4:17:04]: It was quite apparent that this was gonna happen. [4:17:04, 4:17:05]: Right. Um [4:17:06, 4:17:09]: The one thing that I wasn't gonna do, not a dare at the end, [4:17:10, 4:17:14]: was asked for y'all to D annexed the whole subdivision. I was just gonna let'em work for it. [4:17:15, 4:17:35]: I I I I'm just I just I just have a problem with uh i that's what I'm saying. If there's six how many homes have already been deannexed? Is sixty seven homes already been de annexed? When this when with the disapproval I think tonight? I think that's the that'll be that's gonna be already. Does somebody know? Does somebody verify [4:17:35, 4:17:40]: Yeah, bro, right? You got a gentleman right here who can answer that question. Yeah. Yeah. [4:17:44, 4:17:50]: Yeah. The law requires initially you do ten. Again, did it add up to sixty seven? Not right now. [4:17:51, 4:18:11]: So right, so it's not the end. So I that's what I'm saying. I want the information right. I don't want it to be I thought it was. I want the exact one. I can't I do not believe for a second that somebody would have told sixty-seven people that you could save money by staying in the city and all 67 would leave. They're only getting one side. [4:18:11, 4:18:25]: of the story. It's pretty clear. I can find, I could go there and find one person that say, listen, are you kidding all the discussions we've been having about taxes and everybody all upset about taxes, I'm gonna vote to raise my own taxes? [4:18:26, 4:18:33]: That's a hard discussion for me to sit here and be like, sixty-seven people are gonna decide, oh, I'm gonna vote for a tax increase. [4:18:33, 4:18:53]: So the HOA president is here up mayor if he doesn't mind. I think they only get one side of the story. I think they get one side of the story and that's what it is. They need to get the other side of the story. It's not a public hearing. So it'll it's not a public hearing. Okay, got it. No, it's not, but does that mean that we can't let him come up and speak? [4:18:53, 4:19:02]: Speak about this de annexation if he's here. [4:19:03, 4:19:10]: To DNA. You don't need him to tell you that. They shouldn't be able to tell us that. They don't know. [4:19:10, 4:19:12]: Can we have a map with all the properties already out? [4:19:12, 4:19:14]: Yeah, it's like thirty nine. [4:19:14, 4:19:25]: So let me just say this. So here's the m here's the map w with all of Well, this is phase three, but it includes let me find a better map. [4:19:28, 4:19:30]: Phase one and phase two. [4:19:33, 4:19:40]: Let's phase four if you if you have if you have roughly ten ten parcels. It's it's approximately forty altogether. [4:19:40, 4:19:42]: So that means you've got twenty seven left. [4:19:43, 4:19:43]: Yes. [4:19:44, 4:19:53]: And if one person says, Oh, I don't wanna do it, then it breaks the chain, right? But we haven't Oh no, that's that doesn't work like that doesn't work that way. We haven't had anything in a couple of months though. [4:19:53, 4:19:56]: What do you mean? We have about half left. [4:19:56, 4:20:16]: But they have to tuck they have to be touching the city limits, right? No, no, the count I mean they have to not to be t they have to be consecutive, right? So contiguous. So if one person in that s in that puzzle says, I don't I I don't want my taxes raised, then you can't jump over them. [4:20:17, 4:20:19]: It depends on where to locate it. [4:20:19, 4:20:31]: Can't jump up. But they've been contiguous, one up like a puzzle pieces. So if one person would have came out early on, we wouldn't be at this person. But let Mr. Garner explain, sir. [4:20:31, 4:20:37]: Understood. And I understand where you're coming from, Mr Alexander, but I also want you to see the other side of that equation, right? [4:20:38, 4:20:40]: So you are people who want to di annex into the city. [4:20:41, 4:20:45]: Right. The county specifically said, Well, okay, we oppose that annexation, but at the end [4:20:46, 4:20:49]: They don't submit any documentation to hip to DCA. [4:20:50, 4:20:55]: And after the forty five days we vote, we annexed them in because they chose to want to come into the city. [4:20:55, 4:20:56]: Right. In this case [4:20:57, 4:20:59]: You are folks who are making a decision. [4:20:59, 4:21:00]: However they doing it. [4:21:01, 4:21:02]: To want to go out. [4:21:03, 4:21:04]: Right. And [4:21:05, 4:21:08]: You know, I don't know if it's our role. [4:21:08, 4:21:11]: To say we gotta persuade these folks to stay in. [4:21:12, 4:21:14]: No, no, no, no, no, no. Let me stop you right there. [4:21:15, 4:21:35]: We do not advocate. We go out and give educational forums, just like we did during the City of Eagles Landing debate, where they get to see the pros and the cons of what it is. They give full presentation and then we actually send out information on a card saying, Do you do [4:21:35, 4:21:47]: you understand that this is the Stockbridge tax rate and do you understand this is the Henry County tax rate? We just wanna make sure you are fully aware what you're doing. Right. And so [4:21:48, 4:21:53]: Every homeowner on this list that has come before you [4:21:55, 4:21:58]: And I'm gonna put it I'm gonna put it like this, sir. [4:21:59, 4:22:01]: Every b homeowner in that subdivision is an adult. [4:22:02, 4:22:02]: Mm-hmm. [4:22:03, 4:22:04]: Де кін мейка. [4:22:06, 4:22:08]: Right. And if they want to get information. [4:22:09, 4:22:10]: It's an easy call. [4:22:11, 4:22:15]: An easy drive to say, Hey, community development Stockbridge. [4:22:17, 4:22:25]: Boy, if we'd a did that for City of Eagles Landing, we might be broken by now. Well, s no, not that and I think you you you're comparing apples to to to cabbage. [4:22:26, 4:22:27]: Right. I mean [4:22:27, 4:22:32]: At the at the end, and not to be and I'm I'm not being confrontational. I I just want [4:22:33, 4:22:33]: You know [4:22:34, 4:22:39]: I'm I'm pro government, but at at some point I think every citizen has that free right. [4:22:40, 4:22:42]: On how far we go as a government, right? And if they feel [4:22:43, 4:22:44]: Certain way that's fine. But [4:22:45, 4:22:47]: What I'm saying is they [4:22:47, 4:23:07]: Each one of those homeowners had a choice to come in contact it in to be a part of this or not to be a part of it. And if they needed information, yes, okay, we can send information out, but at the same time they could come in and ask for information to make an informed decision. That's what I do. I haven't seen any of them. I haven't seen any of the things. But I'm saying is they they have a choice. [4:23:07, 4:23:26]: are there? I haven't seen any of them. I don't see the rest of them. I see one. But they they we can't leave they they have to form a petition by law, put their name on it, sign that they want to be annexed, and that's what they've done. And they so they're speaking through through this process. [4:23:28, 4:23:28]: All right. [4:23:29, 4:23:48]: All right anyway, so we got we have uh we got oh you you your hands up there, m Ms. I did I did. I was wasn't finished with my question. I I really I know this is not a public hearing. Right. But I I just wanna it sounds like the HOA seems I think the HOA president was telling me that this would make it half of the homes. Is that correct? [4:23:49, 4:24:08]: Okay. And so that means there's another half of the homes that have not deannexed. So we have phase this is what? Phase three and phase four. Phase three and phase four. So that's about twenty homes. We're additional homes. We're ma max out about forty. Right. There's sixty seven in the total community. Right. And so [4:24:09, 4:24:17]: Uh let me explain what has taken place. I went into the neighborhood and knocked on some of the doors. No, I did not have a [4:24:17, 4:24:18]: Um I spoke to [4:24:19, 4:24:21]: Um one of the officers within the community. [4:24:22, 4:24:39]: And I actually knocked on the doors on several residents. I met with some of them. I sat in their homes and talked to some of them. I showed them the tax rate difference on some, not all, of the community. And they still [4:24:39, 4:24:43]: Th some those people opted to [4:24:43, 4:24:45]: D NX. There were a few. [4:24:46, 4:24:47]: Who had questions? [4:24:48, 4:24:51]: And I produced the document showing them. [4:24:52, 4:24:54]: the difference in the tax rate. [4:24:55, 4:24:57]: But they still didn't come to the meeting. [4:24:58, 4:25:00]: And they did not object. [4:25:00, 4:25:11]: Right. Even though they were curious as to that um one person had a complaint about the trash, whether or not they I mean I I got a complaint or two about [4:25:11, 4:25:16]: trash pick up t w whether debris needs to be in a box or not or [4:25:16, 4:25:20]: where the location needs to be and if it's not quite clear and stuff like that. [4:25:20, 4:25:22]: But other than that. [4:25:22, 4:25:30]: Uh yeah, I had two that did that. Other than that, no one has come here. And you're right, I have not had a a a town hall. W well [4:25:31, 4:25:43]: Marnock Village is having one tomorrow. But I haven't had an an additional town hall. I can ask that staff send out just a letter. If they want to annex back in, they can. Um the other the others [4:25:44, 4:25:46]: So I will um ask that we [4:25:46, 4:25:55]: agreed to just send out a letter of notification on the facts for that particular area in the community. We had talked about that. [4:25:55, 4:26:02]: But um you know, just list the facts and and they you know, we can't advocate one way or another. [4:26:02, 4:26:22]: by law and so we just list the facts. But I did knock on doors. I I not just call because I I wanted to know and wanted to hear and and especially since they were just annexed then. And there is a law though uh that basically states and some of our sister cities have dealt with this as well, where [4:26:22, 4:26:42]: um the county had gotten the bright idea to try to de-annex certain locations. Um but you can't de-annex if people or the municipality relied on a particular area for bonding purposes. So a lot of the city, the majority is secured due to that. This happened to be a loophole because Bundy had our [4:26:42, 4:26:46]: already taken place prior to their their particular [4:26:46, 4:26:51]: um incident. Other than that, um de annexation would not have been [4:26:51, 4:27:00]: they wouldn't be eligible for it and and based off the location um of continuity. And so that stops some others. And and that way [4:27:00, 4:27:12]: we know that we can just relate the facts, um, go ahead and submit those documents to the entire community, even those that have been de-annexed, um, for the purpose of disclosure. [4:27:13, 4:27:15]: I support that. [4:27:15, 4:27:20]: And other than that, um, I've always stated that people have a right to [4:27:20, 4:27:25]: um, do what they want to do and they have chosen to D annex right now. [4:27:25, 4:27:27]: I would like to take the high road. [4:27:27, 4:27:29]: In allowing de annexation. [4:27:30, 4:27:31]: As compared to [4:27:31, 4:27:48]: us denying something knowing that it sh it would get approved and wasting the uh time of uh of it going and waiting forty five days and going up and someone wasting legal fees. Those are things and that has happened in the past. [4:27:49, 4:28:09]: from um the county and I don't agree with that process when people want to annex into the city and they know that there is not a valid you know uh that we sh they should just be allowed to annex. We're not gonna play those political games. And I've said that one time before. I think we should take the high road. So having said that I [4:28:09, 4:28:14]: I'd like to make a motion to approve the de-annexation of the properties that Mr. Anderson just listed. [4:28:15, 4:28:23]: Yeah, I will second that with you putting in the motion that we're gonna send out this information to everybody in the subdivision with the facts. [4:28:23, 4:28:36]: Yes. Well in in addition to that, we will also send out the information to the entire Manderley subdivision with the facts about our taxes and um the benefits of being in the city of Stockbridge. [4:28:36, 4:28:41]: Second. All right. Uh any further discussion? If not, um uh [4:28:41, 4:28:45]: Neither mo one motion has been made, so all all in favor? [4:28:46, 4:28:52]: Un announ decision, okay. And Ryan, this uh Mr Anson, this letter that you have in front of us, this was not part of a pack. [4:28:52, 4:28:53]: Packet. So [4:28:54, 4:29:03]: If you can give us a copy of that as well, all of us. Yes, sir. I'll send it to you. Yeah, this one and and probably have the same thing for the next uh next point coming up as well. So yes, ma'am. [4:29:05, 4:29:25]: No, it's just for 18. We we need to vote on 19. We need to vote on 19. That's only 18. Okay, de-annexation case DX two zero two four-zero four for manly subdivision phase four. Considerational ordinance to de-annex from the corporate limits of the city of Stockbridge. Nine parcels within the manly subdivision representing phase four. The request was made by the only [4:29:24, 4:29:29]: nine parcels which would become part of unincorporated Henry County. Mr. Ryan, please. [4:29:30, 4:29:30]: Okay. [4:29:32, 4:29:33]: So I'm [4:29:36, 4:29:38]: These are the um [4:29:40, 4:29:45]: Two, four, six, eight, nine for uh phase [4:29:47, 4:29:48]: Four. [4:29:50, 4:29:50]: Let me see. [4:29:51, 4:29:56]: Okay, could you read those uh addresses in record please?'Cause I sure the can't see. Okay. [4:30:10, 4:30:30]: Okay, so it's 115 Jasper Drive, 145 Jasper Drive, 150 Jasper Drive, 340 Kareet Drive, 350 Karit Drive, 360 Karit Drive, 370 Karit Drive, 615 Edgecomb Drive. [4:30:30, 4:30:32]: Drive six twenty-five edge comb drive. [4:30:36, 4:30:42]: All right, thank you, sir. If there are any not any questions and motion to accept this So moved. Is there a second? [4:30:43, 4:30:59]: I'm Mr. B Mr. Barrett's second then. All fair pleasing the K. All right, dynamic decision. Okay, thank you. Uh on that note, uh council of consideration approved the twenty twenty-three bad debt write-off in the amount of eleven thousand four hundred and twenty-eight dollars and sixty-one cents. Frank's back at us. [4:31:01, 4:31:21]: Good evening, Mayor and Council. Um bad debt means uh the chances of correcting uh the date is almost zero. So I wanted to give a background of uh how did we arrive to that amount of eleven thousand [4:31:21, 4:31:28]: four hundred and twenty eight. So in two thousand ninety three at twenty twenty three. [4:31:30, 4:31:31]: We had collected [4:31:36, 4:31:37]: Four [4:31:37, 4:31:43]: and seventeen four million and seventeen thousand one hundred and eighty one. [4:31:44, 4:31:46]: Out of that we corrected the [4:31:48, 4:31:56]: We had a bad debt and that was representation of ninety nine point nine nine seven percent. [4:31:57, 4:32:01]: Correction of ninety nine point nine nine. [4:32:03, 4:32:05]: percent of correction. [4:32:06, 4:32:09]: And then we had the eleven [4:32:10, 4:32:21]: thousand four hundred and twenty eight and sixty one cents that we did not collect, representing zero point zero zero three percent. [4:32:24, 4:32:44]: So when you think about eleven thousand, think about how much did we collect and what percentage it is. Now you may ask how did we arrive to have uh uh bad debt that it has almost zero percent of collecting. We have uh clients that the move [4:32:43, 4:32:45]: Yeah. [4:32:45, 4:32:49]: that we don't have even their contacts where they go. [4:32:49, 4:32:56]: And our collection company they have tried all means of collecting that. [4:32:57, 4:32:58]: It has not happened. [4:32:59, 4:33:01]: It does not mean that he [4:33:01, 4:33:05]: we may not collect some of these we may recover. [4:33:05, 4:33:09]: The time we recover will classify them as a [4:33:09, 4:33:17]: revenue, miscellaneous revenue, and we'll put back to the book of that time because twenty twenty-three is gone. [4:33:18, 4:33:30]: So the request is we to consider accepting that zero point zero zero three percent that we could not correct in twenty twenty three. [4:33:33, 4:33:36]: All right, thank you, sir. Any questions for Frank? Council? [4:33:37, 4:33:39]: Yeah, if not need a motion to accept this uh [4:33:40, 4:33:43]: Bad debt write off of twenty twenty three. So moved. Is there a second? [4:33:45, 4:33:48]: Mr. Bear from Ms. Gantton, Mr. Barrett. All in favor, please indicate. [4:33:48, 4:33:50]: Nancy Sisney. Okay, thank you, friend. Appreciate that. [4:33:53, 4:34:13]: All righty.
