It's an ordinance to allow additional license and locations in the city for several type of businesses. [0:08:10, 0:08:30]: Consideration of an ordinance to amend the City of Stockbridge Code of Ordinances relating to dealers in distilled spirits, pawn shops, tire shops, used car dealerships and precious gems, also as to clarify the number of licenses available. [0:08:30, 0:08:35]: and to provide for a process for allowing additional licenses [0:08:35, 0:08:37]: Based upon census data. [0:08:40, 0:08:41]: Are you presenting? [0:08:41, 0:08:43]: Give us your name, please. [0:08:45, 0:08:48]: Would you turn the microphone on please and speak into it? [0:08:49, 0:09:01]: My name's Jordan Bukoltz. I am the GIS analyst for the city. I'm here to discuss the ordinan ch ordinance change pertaining to the issuance of licenses for distilled spirit sales. [0:09:03, 0:09:18]: Currently the code states that no additional licenses for liquor stores can be issued until the city's population reaches twenty thousand residents, at which time one additional license may be permitted for each five thousand residents over that twenty thousand threshold. [0:09:21, 0:09:28]: For reference, here is a map of the currently located four liquor stores present in the city. [0:09:29, 0:09:32]: These locations are indicated by the black stars on the map. [0:09:36, 0:09:43]: So I'm here to discuss the section of the code that is to be added in replace of title nine, chapter four, section ninety. [0:09:43, 0:09:48]: Since the population threshold of twenty thousand residents has now been met. [0:09:48, 0:09:57]: So this change applies to dealers in distilled spirits, as well as pawn shops, tire shops, used car dealerships, and precious gems. [0:09:58, 0:10:04]: For this presentation, I will be focusing on the section of the ordinance pertaining to the additional [0:10:04, 0:10:24]: Location restrictions for distilled spirits, retail licenses. So it is stated that no license shall be issued unless the store is located within 500 feet of the following five areas. And a map on the upcoming slide will show these five areas in more depth. But first, I would like to highlight [0:10:24, 0:10:35]: The applicable Georgia state law that requires the sale of spirits to be at least 100 yards from any church building or 200 yards of any school building. [0:10:36, 0:10:56]: So, this is the aforementioned map showing the five areas in which a proposed liquor store must reside according to the updated ordinance. So, you can see on the map there are also symbols showing the locations of churches and schools within the city. And on the upcoming slides, I will zoom into each of these. [0:10:56, 0:10:58]: These five locations. [0:10:59, 0:11:01]: So starting with area one. [0:11:01, 0:11:06]: These are the portions of Mount Zion Parkway and Highway one hundred thirty eight. [0:11:07, 0:11:13]: Line west of I seventy five. So we can see I seventy five up in the top right corner of this map. [0:11:16, 0:11:23]: Area two is the portions of highway one hundred-eight and north henry parkway line east of I seventy five. [0:11:24, 0:11:33]: Which you can see over on the upper left side of the map. I included a map with both the churches and schools as well as one without because it got a little busy seeing all the churches and schools up there. [0:11:36, 0:11:42]: Moving on to area three, these are the portions of Eagles Landing Parkway and Hudson Bridge Road. [0:11:43, 0:11:51]: Um this is all the way from the intersection with Highway 42 over on the right side of the map to the westmost city limits line. [0:11:55, 0:12:01]: Area four is the portions of Rock Quarry Road lying east of I seventy five. [0:12:04, 0:12:12]: And finally, area five is the portions of Jodoko Road that are at least the distance restrictions of a church and or school building. [0:12:16, 0:12:29]: And so according to the updated ordinance, two liquor stores will be added now that the population threshold has been met, and a lottery system will be in place to grant the addition of the two new licenses. [0:12:30, 0:12:43]: So you can see there is a tentative timeline for this lottery process. The ordinance adoption will take place on February 12th, and the lottery would be held at the council meeting on April 8th. [0:12:46, 0:12:52]: And this is an overview of the requirements in place for potential applicants looking to open a liquor store. [0:12:53, 0:12:58]: Um note that the last day to apply for these applicants would be April first. [0:13:00, 0:13:08]: So thank you all for your time and attention. If you have any questions, I'm happy to take them at this time or go back to any of the maps if you're curious about the areas. [0:13:08, 0:13:12]: Uh Mr. Chairman, may I speak? Go ready, yes sir. [0:13:12, 0:13:28]: Uh wha how do you conduct this lottery system? Um I don't think we have any knowledge of that. What exactly do you do for this lottery system to select whoever needs to uh acquire a liquor store license? [0:13:29, 0:13:36]: So all applicants will submit by April first and then at that council meeting on April eighth, um all applicants will be [0:13:36, 0:13:39]: It'll be written on a piece of paper, put into a bin. [0:13:39, 0:13:45]: Uh the paper needs to be folded twice, all the same size and two will be drawn from that. [0:13:45, 0:13:47]: And and who's folding the paper? [0:13:50, 0:13:52]: I can't quite remember. [0:13:53, 0:14:04]: I I I'm I'm just trying to figure out if it's systems fair or not. That's that's my really what I'm trying to find out because we really don't know how that system works. [0:14:07, 0:14:19]: Now I know you indicated all these places which you can put liquor stores, the distance and everything, but you d we don't really know how the lottery system works. [0:14:20, 0:14:23]: And that's what I'm getting at in this conversation. [0:14:25, 0:14:29]: And you may want to consider having something a little bit better than folding paper. [0:14:30, 0:14:33]: Just food for thought if you don't mind. Mhm. And that's all I gotta say. [0:14:36, 0:14:38]: Any other comments from the commission? [0:14:42, 0:14:44]: Thank you, George. Thank you. [0:14:47, 0:14:50]: At this time I will entertain a motion. [0:14:51, 0:14:55]: to approve the text amendment case T X twenty twenty four dash oh one. [0:14:57, 0:15:01]: Mr. Chairman Dave Planshin would like to make a motion to approve it. [0:15:03, 0:15:08]: Is there a second? Harrow second it. It's been moved improperly second. [0:15:09, 0:15:16]: That the text amendment case TX twenty twenty four dash oh one be approved. All in favor, let it be known by the sound of aye. [0:15:17, 0:15:18]: Oh okay. [0:15:18, 0:15:24]: Inepposed? Does I have it? The case is approved. Thank you. [0:15:30, 0:15:32]: Next on the agenda [0:15:35, 0:15:36]: His [0:15:40, 0:15:42]: A redevelopment case [0:15:45, 0:15:50]: That entails a comprehensive plan amendment, a rezoning. [0:15:51, 0:15:55]: application and a variance application. [0:15:56, 0:16:01]: I will read all three into the record before staff presents. [0:21:18, 0:21:28]: And this is the f site business that was done on January fourth, twenty twenty four, with the existing house. Um there is an existing driveway in that area and this is the side where it's posted. [0:21:32, 0:21:47]: And this is the site um this is from adjacent from the property, which is a church at Stockbridge, uh Lacey Hawk is minister, and this is a building with the three businesses adjacent as well, which is Herbal Roots LLC, DNJ Printing, and TDK Designs. [0:21:51, 0:21:54]: And now we're into the presentation for the comprehensive plan amendment. [0:21:57, 0:22:03]: The applicant's request is to change the future land use designation from low density mixed use to special purpose. [0:22:06, 0:22:26]: And this is the meant this is what is mentioned in the comprehensive plan amendment, in which it states that the designation has been developed to allow for special innovative projects which could include anything from different model residential to larger mixed use or commercial development. Since the applicant is building townhomes on smaller lots, the special purpose future land use [0:22:26, 0:22:27]: Designation will be compatible. [0:22:31, 0:22:38]: And this is the joint zoning map of the parcels. This is 135 East Atlanta Road, and this is three oh five East Atlanta Road. [0:22:43, 0:22:53]: And this is the joint overlay map of the parcels. Uh one hundred thirty five East Atlanta Road is located here and three oh five East Atlanta Road is not part of the uh Parkway mixed use overlay district. [0:22:56, 0:23:05]: And this is the joint future land use map showing the uh 135 East Atlanta Road and 305 East Atlanta Road as part of the low density mix use. [0:23:09, 0:23:29]: This is the surrounding land use designation. The property to the north is low density mixed use. The property to the south, which is a daycare daycare center, is in the downtown, is in the downtown district. Property to the east is just the single-family residences, is low density mixed use. Property to the west, which is the church, an existing home. [0:23:29, 0:23:34]: is medium density residential for the church and the existing family residence is is in downtown district. [0:23:36, 0:23:46]: And this is the surrounding land use densities. Um it ranges from six point two units per acre for the DR Horton Town homes located at fifty-five Valley Hill Road. [0:23:47, 0:23:52]: And the lowest, which is the Spanish Villa subdivision, which is twenty eight units, and it's one a half units per acre. [0:23:56, 0:24:05]: Um, this is the project information. The applicant proposes to build a townhome development with 27 units, with five guest parking spaces, and a mill kiosk. [0:24:07, 0:24:09]: And this will be further discussed in the rezoning. [0:24:12, 0:24:32]: So we did a staff analysis, and the key points from the staff report is that the special land use designations is compatible with all the zoning districts, which includes the requested MFR district. It is consistent with the housing goals and policies, and the housing goals, which is mentioned here, is to provide. [0:24:32, 0:24:52]: Additional housing in the downtown core downtown core and the housing policies that's closer within the Compline that the proposed townhomes will meet is to preserve and enhance older existing neighborhoods by promoting rehabilitation of existing stock and infill of new development to revitalize established neighborhoods. [0:24:56, 0:25:13]: The property is suitable since it will provide housing options for the residents who are interested in living close to the downtown area. In addition, the townhomes are within walking distance of both the amphitheater and the downtown area and is within distance of the Clark Community Park. [0:25:16, 0:25:18]: And staff recommends approval for the Complet Amendment. [0:25:25, 0:25:30]: And on the next slide, the next presentation will be on the Rizona case, R C twenty three oh nine. [0:25:40, 0:25:48]: The applicant's request is a reson from SR, suburban residential, to MFR, multifamily residential, to allow for the uh townhome development. [0:25:52, 0:26:01]: This is the uh the site plan with the parcels labeled. The site the properties were combined as part of the re-recombination plan process that took place last year. [0:26:05, 0:26:08]: And this is the side plan showing the twenty seven units. [0:26:16, 0:26:19]: This is the develop development data summary for the site plan. [0:26:26, 0:26:33]: And this is the exteriors the exterior elevations. Um they will have a two car garage and it has a front elevation of brick. [0:26:38, 0:26:44]: And on the side as well, this is on the side, and this is the view from when you enter into the uh into the townhomes. [0:26:44, 0:26:44]: Yeah. [0:26:50, 0:27:03]: And on this slide, the twenty twelve Lib Livable Centers Initiative Study labels the surrounding area of the subject property as growth center, where growth is highly recommended. And as you can see, the property is part of that growth area. [0:27:09, 0:27:21]: In addition, the property is part of the TAD, which is the tax allocation district, which is designed to attract quality development to the distressed redevelopment area. And as you can see, the property is part of that. [0:27:26, 0:27:31]: And on this slide, these are the sample of the townhomes that are that will be desirable in the city of Stockbridge. [0:27:33, 0:27:33]: These are samples? [0:27:39, 0:27:54]: And now we go into the project description. The applicant proposes to build a twenty-seven unit townhome development at a density of sixteen point three six units per acre on one point six five acres of land at 105, 135 and 305 East Helena Road. [0:27:56, 0:28:07]: The units will be three bedrooms and the size of the twenty-seven lots are eighteen hundred square feet with fifty-nine parking spaces that will be provided for the residents, and that includes the kiosk. [0:28:13, 0:28:20]: The key points to take away from the staff report that we did was that it's compatible with the goals of the comp plan as mentioned. [0:28:20, 0:28:23]: Uh which is to provide additional houses in the downtown core. [0:28:24, 0:28:36]: And it also fits with the policy of the comp plan, which is to preserve and enhance the older existing neighborhoods by promoting rehabilitation of existing housing stock and infill of new development. [0:28:44, 0:28:49]: And it also fits a special purpose district since the applicant is building townhomes on smaller lots. [0:28:52, 0:29:02]: And it's c it is compatible with the sixteen units, sixteen point zero one units and twenty four units per acre that is required for the special purpose district. [0:29:05, 0:29:25]: In addition, it is consistent with the UDC. It meets the MFR density requirements, which is 14 units per acre. And it also meets the criteria of the Parkour Mixed Use Overlay District, which is to improve public health and to provide safe and efficient movement within the overlay district by promoting the development. [0:29:25, 0:29:30]: development patterns that encourage physical activity such as walking and bicycling. [0:29:34, 0:29:47]: And the potential if positive effects, the downtown area has not seen any residential growth while other areas in the city have seen significant growth. Thus, this will serve as a catalyst for future development in the downtown area. [0:29:51, 0:29:59]: And there is a need for a housing stock in the downtown area, so it will provide an alternative type of housing that what currently exists in the vicinity. [0:30:01, 0:30:11]: And many of the townhomes in both the Spanish village subdivision and the H H Dival subdivision were built from the nineteen twenties to recently as two thousand six. [0:30:14, 0:30:24]: And the L CI LCI study and the downtown residential retail market analysis that was conducted by Georgia Tech encourages growth in the downtown area. [0:30:33, 0:30:53]: And the LCI did state that it should provide pres appropriate transitions between new development and existing neighborhoods. In addition, it did say that these could include conventional techniques such as buffer or innovative site plan that uses small lot, single family houses, or townhomes to make the transition. [0:30:53, 0:30:56]: Which includes this the third part which says transitional use. [0:31:01, 0:31:13]: And it will provide walking distance for the residents from the amphitheater, downtown area and the clock park, and it'll incorporate new urban cent urbanism concept by having the frontage of the townhomes to the sidewalk. [0:31:21, 0:31:22]: Yeah, just as uh [0:31:24, 0:31:44]: And it says also in the LCI that to position stop bridge for changing local and regional and national market demographic trends, particularly the needs of aging residents and the so-called millennium millennials, the downtown must be revitalized in a way that builds on historic character and position as is it is as a walkable [0:31:44, 0:31:50]: Mixed use alternative to surrounding areas, many of which will be less suitable to these changes. [0:31:53, 0:32:13]: And the size of the parcels won't allow development of the townhomes. Thus the applicant has submitted three variances, which will be heard in the next presentation. And that water service is available for the subject property. However, it says that the letters did state that the reservation of capacity will expire if the plans are not submitted. [0:32:13, 0:32:16]: within one year, which is January twenty second, twenty twenty five. [0:32:18, 0:32:32]: And on this map, it does this shows the distance from Clark Community Park, which is 0.5 miles, the distance to the downtown area, which is 0.3 miles, and the distance to the amphitheater. So it does prov it will provide walking distance. [0:32:38, 0:32:58]: Staff recommend staff recommendation. The staff approves approval with conditions to rezone the subject property from SR to MFR with the conditions that includes that a 10-foot sidewalk shall be established across the frontage. The proposed development shall include a two-car garage. The proposed townhome shall be constructed according to design. [0:32:58, 0:33:18]: Which is similar to the one that is shown on the applicant submitted site plan entitled Preliminary Site for 135 East Town Homes, which is prepared by Y Studio, dated August 20th, 2023, and represented on the sheet number A-0.1. The project will be in conformance with the Cedar Stockbridge Unified Development Code. [0:33:18, 0:33:29]: and other city code sections regarding the site development standards and other requirements that are found, and that the townhomes shall be comprised of brick, stone, cement-based siding, and shake siding. [0:33:34, 0:33:37]: And now we're going on to the variance twenty twenty three dash zero five. [0:33:39, 0:33:59]: As mentioned, the applicant request is requesting three variances from the MFR development regulations found in the UDC. These variances, as shown in the table, which is next, are as follows: which is reduce the front yard setback from 50 to 15 feet, reduce the required side yard setback from 15 to 10 feet, and increase the allowable maximum coverage. [0:33:59, 0:34:01]: average from fifty to sixty percent. [0:34:04, 0:34:24]: And these are the district standards. Um MFR requires front yard setback to be 15, the side yard setback to be 15 feet, and the maximum locker average to be 50. However, as shown in the green, the applicant wants to reduce this from 15 to 15 feet, the side yard to 10 feet, and the maximum locker average to 16. [0:34:24, 0:34:25]: Sixty percent. [0:34:28, 0:34:48]: The key points to take away from the staff report, the staff analysis, is that the size of the subject property is 1.65 acres, which is uniquely small compared to the other recently approved townhomes, which can be shown on in this table. The lot width is 104 feet, which is small, and overall these factors make it extremely [0:34:48, 0:34:51]: difficult for the developer to build the townhomes. [0:34:56, 0:35:16]: The variance meets the purpose and intent of the UDC since it would encourage the most appropriate land use of the subject property, which would be the townhomes. The reduction of the front yard setback from fifty to fifteen feet will be advantageous since the proposed townhomes are located in the downtown area and will provide walking distance for the subject. [0:35:16, 0:35:19]: [2119.2, 2129.8]: And due to the size of the property, the applicant may be deprived of the ability to develop a townhome community that is similar to the sizes of the other townhomes that are found in the MFR district. [0:35:33, 0:35:38]: And staff recommends approval for the variance. And that concludes the uh presentation. [0:35:40, 0:35:43]: May I speak. Any questions for [0:35:45, 0:35:51]: Stay. May I speak, Mr. Chairman? Go ready, yes sir. Uh what is the tax [0:35:51, 0:35:54]: Allocation district what [0:35:54, 0:35:57]: What does that that mean, if you don't mind? [0:36:05, 0:36:07]: Just a parcel that you know. [0:36:08, 0:36:10]: That's really the last problem. [0:36:10, 0:36:11]: Uh uh. [0:36:27, 0:36:28]: Any other questions from staff? [0:36:31, 0:36:42]: Well well he never did answer my question. I asked him what was the allocation district. What is that? [0:36:42, 0:36:43]: Yes. [0:36:49, 0:36:50]: Parts will I do them. [0:36:51, 0:36:55]: I mean is there some reduction or anything? I mean [0:37:02, 0:37:03]: Okay and that [0:37:05, 0:37:08]: Yeah, would that be for collection? But when you say a district [0:37:09, 0:37:16]: That means something else to me. Yeah, you you have tax allocation district. What is that? [0:37:18, 0:37:18]: No. [0:37:20, 0:37:30]: that the city uh recently introduced downtown as a special taxing purpose to increase the revenue for uh to improve down to use the revenue. [0:37:33, 0:37:34]: Okay. Is [0:37:40, 0:37:41]: [2262.0, 2265.4]: So is that a reduced tax? No, it's actually [0:37:47, 0:37:47]: Okay. [0:37:51, 0:37:52]: All right, thank you. [0:37:56, 0:37:58]: Any other questions for Staya? [0:37:59, 0:38:06]: Go right of here, sir. I have a couple of questions. Um, what are the anticipated values of these townhomes going to be? What do you think they will sell for? [0:38:07, 0:38:09]: Question. Do you say that till that can come? [0:38:10, 0:38:11]: That's that we don't know that's the [0:38:12, 0:38:13]: Okay. [0:38:14, 0:38:19]: So the applicant wan the the applicant answered that question, so you can come up. [0:38:22, 0:38:26]: Before the applicant comes, I I wanna make sure there were no other questions for staff. [0:38:29, 0:38:37]: Thank you, Mr. Linton. Applicant, please come forward, state your name and address, and make your presentation. [0:38:40, 0:38:41]: Yes, sir. [0:38:43, 0:38:43]: Come again. [0:38:46, 0:38:50]: Before the staff before the applicant presents? [0:38:54, 0:38:57]: Okay. Hold on just a second, sir. [0:39:01, 0:39:04]: This case requires a public hearing. [0:39:06, 0:39:08]: And I will now convene the public hearing. [0:39:10, 0:39:30]: I have a few housekeeping chores that I must present to you before we get started. Uh the rules are as follows. Please mute all cell phones and other electronic devices. If anyone wishes to speak on a public hearing item, please fill out a form available on the table. [0:39:30, 0:39:35]: table and hand it to the Secretary before approaching the podium. [0:39:37, 0:39:51]: After each case is called, the commission will hear from city staff, followed by the applicant or their representatives regarding the proposed plans for the property along with other relevant information. [0:39:53, 0:39:56]: The commission will be free to ask questions anytime before the vote. [0:39:58, 0:40:08]: Following the applicant, anyone who wishes to speak for, in favor, or opposed to the case will have the opportunity to do so. [0:40:10, 0:40:13]: Each side will be allotted ten minutes total. [0:40:15, 0:40:18]: Additional time may be extended at the discretion of the commission. [0:40:21, 0:40:29]: Please keep comments and presentations professional by referring only to the facts that are pertinent in the case. [0:40:31, 0:40:37]: We will uh not we will not allow comments or personal attacks toward the inner individual or group. [0:40:39, 0:40:45]: Please refrain from any applause or comments from the audience during the public hearing. [0:40:47, 0:40:51]: After the presiding officer recognized the speaker [0:40:53, 0:40:55]: That would be me, the presiding officer. [0:40:57, 0:41:17]: I will direct all comments, I mean the speaker will direct all comments to the presiding officer and never to members of the commission, staff, or the audience. All comments should be made from the podium where you will be required to state your name and address for the record. [0:41:19, 0:41:22]: Please note these hearings are not a debate. [0:41:24, 0:41:34]: Fail to comply will cause you to be removed from the chamber and the billing of law enforcement if you deviate from these procedures. [0:41:36, 0:41:40]: Other than the applicant, no person may speak more than once. [0:41:41, 0:41:53]: The applicant may reserve part of his speaking time as a rebuttal and may speak next and last and may use the entire ten minutes allowed for the pro side of the application. [0:41:55, 0:42:01]: If questions are raised, the commission will ask the applicant to address these questions and concerns. [0:42:04, 0:42:10]: The presiding officer will call for a motion and a second to the motion and have any necessary discussion. [0:42:12, 0:42:19]: If the matter is not tabled, the presiding office will call for a vote to recommend approval or denial. [0:42:23, 0:42:25]: So you may come for it, please. [0:42:27, 0:42:28]: State your name and address. [0:42:30, 0:42:39]: Good evening. My name is Harold Singer. My address is 4034 Lionsgate, Douglasville, Georgia, 30135. [0:42:40, 0:42:58]: Good evening, members of the commission. Um as was stated before, we're here on behalf of the uh proposed development at 135 and 305 East uh Town Home Development. My name is Harold Singer. I am the uh the applicant on this this project. [0:42:58, 0:42:59]: Um [0:42:59, 0:43:07]: The owner is in presence here. His name is Mr. Reginald Sullivan. Um, he's a longtime business uh member of the community. [0:43:08, 0:43:16]: Uh the developers for this project is are Mr. Derek Harris and Celine Morrissey. They make up our emergent development. They are here as well. [0:43:16, 0:43:28]: In addition, we have one of our design professional teams here, Mr. Lewis Juan, that can field any technical questions. Uh the staff did an excellent job of surmising um the the [0:43:29, 0:43:49]: P pertinent information about the townhomes 135-305 East Atlanta, approximately 1.65 acres. We're proposing to rezone it from suburban residential to multifamily residential. We're proposing three 27 three-story townhomes. There's a rezoning, a land use amendment. [0:43:49, 0:43:50]: And uh three [0:43:51, 0:43:55]: Variances that we're requesting to be able to move forward with the development. [0:43:56, 0:44:05]: This is the site plan was already uh put up on the side. As you can see, um the limitations with the existing site, um we're looking to [0:44:05, 0:44:10]: Maximize the site to to bring uh a quality product to the [0:44:10, 0:44:12]: The the community. [0:44:12, 0:44:20]: Um with the hardscape, the on-site parking, the kiosk, things of that nature. That's how we get to the the [0:44:20, 0:44:23]: lot coverage higher than what the allowable is. [0:44:25, 0:44:36]: Um this is a a a rendering. I think it was brought up earlier. Um we're looking to bring a quality product to this development to you know enhance the the downtown city stockbridge area. [0:44:37, 0:44:39]: There's another rendering here. [0:44:39, 0:44:59]: This is a front elevation which will consist of uh as was stated brick front, cementus siding. Um the project was designed to maximize the fenestration, to utilize natural light. Um we have several places for people to um kind of go outside. [0:44:59, 0:45:11]: on on on multiple levels of the property. That's the front elevation. This is the rear. As you can see they have rear entry double uh two-car garages uh with um [0:45:12, 0:45:14]: Decks that protrude out, um [0:45:15, 0:45:15]: Let's see here. [0:45:16, 0:45:21]: Here's a side elevation for the the end units that would have an additional box balcony. [0:45:22, 0:45:38]: Um with that, um the first question I think that was posed, what would be the price point at this point um is preliminary as we continue to go through this process with Stockbridge, but our our plans are to have a uh starting price point at 300,000. [0:45:40, 0:45:49]: So with that I'll yield to any questions. Um and you know, whoever is appropriate to respond, either myself or the developers, owners and or the [0:45:50, 0:45:52]: design professional will respond accordingly. [0:45:53, 0:45:55]: Any questions for the applicant? [0:45:56, 0:46:09]: Mr. Chairman, I have some questions. So about the three hundred K, so how did you come up with that? Did you go to a radius in a county, other uh like communities? How did you come up with that pricing? [0:46:09, 0:46:29]: Well, I mean we're looking at the development costs. Of course we're looking at the marketplace and based on those factors, uh, we feel like um a starting point at 300K, uh it would keep us in line with the market. We we don't want to get too far ahead of our ourselves. The point is to bring some diversity in how [0:46:29, 0:46:44]: housing to this area and we feel that that would be a good price point for you know either people looking to buy their first home or people looking to still be on the south side of Metro Atlanta but then being somewhat of an urban area. [0:46:44, 0:46:47]: Okay. Two more questions. Um [0:46:47, 0:46:54]: So I'm sure that the uh surrounding homeowners will be concerned, but what type of buffer do you intend to put between the existing homes? [0:46:54, 0:46:55]: in the new development. [0:46:56, 0:47:16]: Well, I mean, one of the things that we're asking for is a variance. Um, you know, as we go through this process, we're open to uh dialogue with the staff and community. Um we we look to do some extensive landscaping, um whether that be a fence, whether it be natural uh buffer as far as trees. [0:47:16, 0:47:36]: Trees, fencing, things of that nature. Given the size of the lot, there's not a lot we could do, but we're open to suggestions in terms of being creative. To um, you know, these towns are designed not to be overwhelming, but to fit in the character of which we feel is. [0:47:36, 0:47:48]: is a a center that is close to a downtown area. And as the city of Stockbridge grows, we feel like the development that we're proposing will meet that growth. Okay. [0:47:48, 0:48:05]: And the last question is, um, aside from tonight, have you had the opportunity to speak with the community about No, we have not. What we did was met the requirement to send out mailings uh to the adjacent property owners. Uh we're we're definitely open to that. Um [0:48:05, 0:48:16]: You know, as we come out of post COVID, th I know this is probably one of the few and and more and more going to in person meetings, but we're definitely opening to engaging with the community. [0:48:17, 0:48:18]: Very good, thank you. That's all I have. Thank you. [0:48:20, 0:48:22]: Any other questions from Sarah? [0:48:23, 0:48:26]: Okay. May I speak, Mr. Chairman? Go ready, yes, sir. [0:48:26, 0:48:46]: Uh have you uh spoken to any of the homeowners? Have they sent you any letters pertaining to this development? And my second question is uh crime or are you gonna have HOA uh when you build these townhomes? Yeah, there'll there'll be an [0:48:46, 0:49:06]: HOA um we haven't spoken to any community outside of the the mandated posting uh that we require with registered mail. But as I stated, we're willing and and open to having those dialogues and questions. We want to be uh incorporated in the fabric of the community. Um have there been [0:49:06, 0:49:20]: any response to you since you sent all the mailing out. Has anybody communicated with you from the community? Is my question. No, sir. We have not gotten any uh feedback from those mailings. Well thank you. Yes sir. [0:49:21, 0:49:25]: Anyone else? Uh yes, Mr. Chair. I had uh two questions. [0:49:25, 0:49:40]: Uh a few actually, but some of which you've already answered. I know you said you didn't have any community meetings just yet. Have you uh attempted to have any meetings with the school system in that area? Uh Heron County School system, I know it's Stockbridge, elementary and the high school in that area, Woodland as well. [0:49:41, 0:49:55]: No, we have not. Those are those are uh discussions that as I stated we're willing to have. I know Mr. S Sylvan is a uh a noted member in the community and and that those meetings and and outreach is uh [0:49:56, 0:50:11]: in process. I think we we met the deadline in December and that this was the first meeting um that we were available to come to you all. So, you know, those discussions are are definitely uh something that we're open to. [0:50:11, 0:50:18]: Thank you. Uh one more question, Mr. Chair. Um I'm looking at the map. If you can go back to the uh the map of the in entire site. [0:50:20, 0:50:23]: Oh wait, say player. That one's fine, yeah. [0:50:24, 0:50:26]: Is it only one? Um [0:50:28, 0:50:48]: Access point of egress is that the one in the front? Yes, sir. Yes, sir. That there's there's one way in, one way out at this point. I know that there's been some preliminary discussions with the fire department. And you know, this is our initial design. Um we we're really looking to staff to kind of give us some feedback as [0:50:48, 0:51:04]: as to what they felt was appropriate. Of course, we know we have to engage with the fire department for life safety, but you know, given some of the limitations with the site and the density that we look for, that that's what we initially are proposing. [0:51:05, 0:51:25]: Okay. Uh I definitely want you to go back and kinda see um how we can add some environmental friendly like greenery. I like how you said the buffer of greenery. That would be a great option I would suggest to you. But I will also suggest because I know our chief of uh fire, he's he's gonna fight you about that one uh one way in, one way out. Settled. So I definitely want you [0:51:25, 0:51:27]: to look into that um as well. That's all, Mr. Chair. [0:51:28, 0:51:29]: Thank you. [0:51:30, 0:51:40]: I have a question for you. Yes, sir. How comfortable are you with spreading the upkeep and maintenance costs? [0:51:43, 0:51:46]: over such a small number of owners [0:51:47, 0:51:52]: With the small H O A. Sure. We want to field that question. Excuse me. [0:51:52, 0:52:00]: Uh I just want to respond to um Commissioner uh Williams. Uh we have had discussions with Could you talk into the microphone, please? [0:52:00, 0:52:15]: Yes, uh I just want to respond to your question. We have had conversations with Chief Wells and the fire trucks are able to get in and come out. So uh we otherwise we would not be presenting it as is. So we have addressed that issue as well. [0:52:16, 0:52:19]: Excuse me, sir, would you give your name and address and fill out a sheet? [0:52:21, 0:52:28]: Okay. You want my name now or you want me to fill it out first? Okay, Regis Sylvan, one thirty nine Bay Berry Hills. [0:52:34, 0:52:34]: Yes. [0:52:43, 0:53:03]: And and to your question, um, you know, the market is what it is. I think um with these developments, it's always a challenge um to be where you need to be in the marketplace and not o overprice yourself. Uh I was just having that discussion prior to coming here. A lot of uh these small [0:53:03, 0:53:23]: Smaller townhome developments and multifamily developments have gone away from the amendments, amenities, if you will, because those things tend to increase the cost. Um, but as it is right now, based on our preliminary duck numbers, we feel that the cost of maintaining this site, given that it is a smaller site, would be [0:53:23, 0:53:26]: distributed in a way to not make it be cost prohibitive. [0:53:28, 0:53:46]: Well, your lack of amenities is glaring, I will say. But just for the example, repaving the parking lot could be very cost prohibitive for such a small number of owners. And that's I'm just trying to gauge your comfort level with doing that to people. [0:53:50, 0:54:04]: Yeah, I mean those are things to definitely consider. I I think uh with that type of capital improvement we're probably looking ten to fifteen, maybe twenty years down the road. Doesn't matter. Right. Steel Stockbridge. Citizens. [0:54:05, 0:54:07]: that would be um impacted and affected. [0:54:11, 0:54:22]: I mean we're dealing with things now that people did ten, twenty years ago that didn't make a lot of sense doesn't make a lot of sense now, uh wasn't present then, but we still having to deal with. [0:54:25, 0:54:29]: Like tow trucks riding through people's neighborhoods. [0:54:30, 0:54:31]: Poor planning. [0:54:33, 0:54:34]: Yes, sir. [0:54:43, 0:54:46]: I just wanna gauge his comfort level with doing what he needs to do to make it happen. [0:54:53, 0:55:08]: Anyone else have questions? Yes, yes, Mr. Chairman, I've got a couple more questions. Yes, sir. Um do you envision this as being a primarily an adult um living arrangement, or do you anticipate families with kids would move in here also? [0:55:10, 0:55:22]: Yeah, a adults, young professionals. Uh I mean of course, you know, this is America we're open to, you know, anyone that wants to live there, but it probably would be more marketed towards uh young professionals. [0:55:23, 0:55:25]: Small families, if you will. [0:55:25, 0:55:45]: And maintenance as far as the ground keeping go, what little grounds there's gonna be of it, is that gonna be maintained via the association or the HOA or is individual owners gonna be responsible for maintaining their own little piece of dirt? No, that that will be um as was stated earlier, be part of their a their HOA fees, you know, part of [0:55:45, 0:55:49]: [3349.9, 3363.1]: attractive now is that that that you know, they don't have to worry about those things. And I have one more question. I don't see on the map any ingress or egress. Where is the road actually going to be and where is it going to connect to? [0:56:04, 0:56:06]: Um okay. [0:56:06, 0:56:23]: We're going to certainly meet all of the requirements uh that are necessary. Right now we're just trying to um present this uh project to you guys to take it from single family to multifamily, but we will certainly meet all of the requirements that are set forward. [0:56:27, 0:56:30]: Did that satisfy your question, Mr. Plation? [0:56:31, 0:56:33]: I'm finished like you. [0:56:34, 0:56:38]: If there are no further question, thank you, uh Mr. Singer, Mr. Sylvain. [0:56:39, 0:56:41]: Thank you, uh members of the commission. [0:56:44, 0:56:48]: We will now open this case up for public comment. [0:56:49, 0:56:51]: And the way we're gonna do that, we're gonna [0:56:53, 0:57:08]: Ask first if anyone's present who's in favor of it that you fill out a form if you haven't already done so, form a line and approach a podium, give your name and address, and speak. [0:57:10, 0:57:12]: Are there anyone in favor? [0:57:28, 0:57:35]: Good evening. Again, I'm Reggie Savan. I'm the owner of the property and certainly I'm in favor of it. Um [0:57:37, 0:57:40]: I've been in the area for roughly about thirty years right now. [0:57:40, 0:57:48]: I've seen the downtown area what it is today. I've seen it like this the last 20 plus years. Um [0:57:49, 0:58:05]: If we're looking to bring density to the downtown area, we have to welcome established uh developments like this. Otherwise, the next twenty years we're going to still see what we're seeing today. So again, I'm not sure if [0:58:06, 0:58:14]: We are I'm not sure why someone would be against it other than they don't want to see growth in a downtown area. [0:58:15, 0:58:35]: And I've been developing and buying properties in the downtown, well in Stockbridge since 1998. But downtown in particular, over the last two years, I've purchased at least seven properties in this area. And I've purchased it because Stockbridge is [0:58:35, 0:58:37]: your largest city in Henry County. [0:58:37, 0:58:39]: But we're the furthest behind. [0:58:40, 0:58:41]: You look at McDonough. [0:58:41, 0:58:43]: Well developed downtown area. [0:58:44, 0:58:48]: Hampton, well developed, locust grove. So the question is [0:58:49, 0:58:56]: Do we want to remain where we are right now or do we want to move forward? So that's why I'm in favor of it. Thank you. [0:58:56, 0:58:58]: Thank you, sir. [0:59:01, 0:59:08]: I will now entertain those folks who are in opposition to this development. [0:59:10, 0:59:17]: I'm sorry. I'm in favor also. You're in favor also. Come state your name and address police. [0:59:19, 0:59:39]: My name is Derek Harris, and uh I'm one of the developers um for uh the project. Um though I'm not a resident of Stockbridge, I am a longtime resident. Um I've grew up in South Fulton. I've lived in Clayton County, so I still feel like this is part of the South um side of Atlanta community that I've been. [0:59:39, 0:59:59]: part of my whole life. So I know all about Stockbridge. I've been uh here, um watched it grow, watched it not grow. Um and and uh you know I'm I come to the amphitheater um and I just don't see uh any amenity amenities or um you know restaurants and [0:59:58, 1:00:15]: different things here in the in the community. Um, you know, after the shows, you guys have invested lots of money into this community with the art center. I mean with the uh performing art center, the amphitheater and and so forth. And uh the way you get restaurants, um [1:00:16, 1:00:20]: entertainment, different things like that into a community is through density. [1:00:20, 1:00:30]: And I think this is a uh great product to put here to uh increase the density and to draw uh businesses into the to the downtown corridor. [1:00:34, 1:00:34]: Thank you. [1:00:35, 1:00:36]: True. Thank you, sir. [1:00:41, 1:00:42]: Anyone else in favor? [1:00:44, 1:00:44]: Yeah. [1:00:47, 1:00:51]: Now we'll entertain opposition comments. [1:00:53, 1:00:54]: Same rules apply. [1:01:10, 1:01:18]: Hello, um, I'm Connie Snow, 426, Chase, Miriam Waite, McDonough, Georgia, uh 30253. [1:01:19, 1:01:39]: I'm against this project. I feel like we have way too much development going on in Stockbridge and in Henry County alone. Currently we have, I think, maybe three or four multiple multiple property developments in progress right now that Stockbridge has already approved, and yet we still don't have a solid infrastructure for as yet. [1:01:39, 1:01:59]: Additionally, if this is approved, it looks like you guys are going to allow them to apply for TAD. And if I'm correct in saying that TAD does help with some of the developers' costs, that's part of it. And it also increases the property owners' taxes. I don't think it's fair that we keep having to suffer the brunt as property owners in either Henry County or Stockbridge. [1:01:59, 1:02:08]: Because a developer wants to build. Additionally, I think there's a park close to the area. Was there any research done on the impact of that park in that area? [1:02:08, 1:02:28]: Uh and then one more thing. Uh Gibeon, who is I guess the developer over this community, according to Georgia State Records, their business license is dissolved and not active as recently as September of twenty twenty three. So I do also believe if you guys are going to approve it, we need to make sure that we're using development companies or [1:02:28, 1:02:33]: vendors who are in compliance with Georgia law and have active licenses. Thank you. [1:02:46, 1:03:03]: Good evening. My name is Ann Fields. I'm at uh three twenty nine Chase Marion Way, um McDonough, Georgia. Can I have a question? Um the L sixteen parcel that's in between the um townhome nineteen and twenty. [1:03:04, 1:03:13]: Um what it what is that area on the drawing? It's a blank area. There's no townhome there. And it's twenty feet wide. [1:03:17, 1:03:37]: Go ahead with your STO comments and we'll have the applicant answer your question when we finish. Okay, thank you. Um so my concern was already brought up by um Mr. Williams in regards to um the entrance and the uh and another side exit for the fire safety. Um my second concern is uh center. [1:03:37, 1:03:50]: Around trash pickup and the variance allowance for the the front and b and and e the rear setbacks off the rear of the townhomes. So because these townhomes have no real yards to them. [1:03:51, 1:03:54]: I'm wondering where the garbage can placement would be. [1:03:55, 1:04:15]: Um it doesn't look from the drawing or the discussion that there would be a dumpster pickup for this small community. So if it would be individual trash cans, are those going to be hauled to the street all simultaneously by twenty-seven various people, or how is garbage going to be handled? [1:04:15, 1:04:24]: Handled here. So then that takes me to my concern about where do they store the cans, pest control for that. [1:04:25, 1:04:40]: issue of of twenty-seven or more garbage cans um and very little space. Um if if that's not a dog park between nineteen and twenty, um, being that these are for sale and not an apartment, [1:04:41, 1:04:49]: uh rental units, um, then my concern would be it is a little bit of a distance, especially in extreme heat. [1:04:49, 1:04:50]: Or rain. [1:04:51, 1:05:08]: to get to the public park facilities so anyone with animals would have uh little to no green space for animal excrement and what would be the policy of such a small community regarding uh animal excrement pickup. Um [1:05:09, 1:05:29]: And the other concern I wanted to voice was um planning and zonings overall, granting of variances. Where I came from a variance was a very difficult challenge. And it had to really, really be proven. And there seems to be a lot of variances being granted. [1:05:29, 1:05:49]: granted for these setbacks, um, front, rear sides, all of it. Um, I'm just a little concerned with the overall aesthetic that we're we're giving on all of our projects, not just this one, but just overall. Um, the look and feel of allowing something to be so close to the sidewalk. [1:05:48, 1:05:50]: The look and feel [1:05:50, 1:06:10]: to the existing homeowners whose properties are being in encroached upon with very small setbacks for the for the their sides and rear where they abut up to existing homeowners property. So I'd like you guys to consider uh what's going on with variance applications. [1:06:10, 1:06:20]: for for for the setbacks. Um and if you can start considering some of the more prominent needs that we know will impact all of us. [1:06:21, 1:06:41]: Like the garbage. W obviously Mr. Williams was very concerned as I am with the public safety aspect of these new developments. Um, having a safe way in and a safe way out for our firefighters, for our ambulance drivers, and of course for any garbage pickup that has to occur. So you're not waking people up at three AM with [1:06:41, 1:06:58]: with a truck with his rear beepers on for the entire length of a development to back out of something. But we need to look at pest control and enforcement of pest control and animal excrement for any pets as a whole. We don't want that to get out of hand. Thank you. [1:06:58, 1:06:59]: Thank you, man. [1:07:02, 1:07:05]: Mr. Gideons, Mr Sylvain. I'm sorry. [1:07:06, 1:07:07]: Come right up, sir. [1:07:15, 1:07:21]: Good evening. My name is Benarvis Johnson Senior. My address is three zero five South Spear Road, Stockbridge, Georgia. [1:07:21, 1:07:23]: Original of Henry County, born and raised. [1:07:24, 1:07:26]: I'm opposed with this um project. [1:07:27, 1:07:28]: For one as being [1:07:30, 1:07:33]: A young resident who's looking to become a homeowner. [1:07:34, 1:07:37]: And for something that small, tight and close. [1:07:38, 1:07:39]: It's like clutter. [1:07:39, 1:07:43]: And to sit here and to have that price range. [1:07:44, 1:07:49]: to sit here and say it's for families with no space or yard for you can actually go out. [1:07:50, 1:07:53]: And not have to deal with traffic and so forth. [1:07:54, 1:07:56]: As well as I said, we already have clutter. [1:07:56, 1:08:00]: We already have the villains already going on, which is creating more clutter. [1:08:01, 1:08:03]: And to sit here and look at a property like that. [1:08:04, 1:08:10]: That two houses can be put on with reasonable size as well as space for a young family. [1:08:11, 1:08:12]: Too calm. [1:08:12, 1:08:13]: And and live there. [1:08:14, 1:08:15]: For that price. [1:08:17, 1:08:17]: And so [1:08:18, 1:08:21]: That's why I am against this project. [1:08:21, 1:08:22]: Because again. [1:08:23, 1:08:24]: How it was stated. [1:08:25, 1:08:26]: One way in, one way out. [1:08:27, 1:08:29]: Accidents happen, a lot of things happen. [1:08:31, 1:08:35]: And it's just that clutter, especially with trash pick up for all so many units. [1:08:36, 1:08:36]: And then [1:08:37, 1:08:41]: The type of residence that are coming in каседер із спас хір. [1:08:41, 1:08:43]: In the downtown area. [1:08:44, 1:08:52]: And to just sit here and just like I said, there's already developments going on, which is already gonna be bringing in more residents. [1:08:52, 1:08:53]: And so forth. [1:08:54, 1:08:58]: So that's why I am against this project because honestly for that property. [1:08:58, 1:09:03]: Ак рада сі твої хвороби вид спис. [1:09:04, 1:09:14]: for a family to come as well as to sit here and say, well, hey, this is where I would like to be in the downtown area of Stockbridge, as well as a resident of the Henry County. [1:09:14, 1:09:15]: Family. [1:09:16, 1:09:20]: That's all I would have to say. Thank you, sir. Thanks so much. [1:09:23, 1:09:25]: Anyone else opposed? [1:09:30, 1:09:45]: I would like for Mr either Mr. Giddings or Mr. Sylvain to come back and try to answer some of the questions that Ms. Fields raised regarding the twenty foot alley between nineteen and twenty. [1:09:46, 1:09:50]: The garbage pickup and the animal excrement. [1:09:51, 1:10:11]: So I they the these two gentlemen spoke and read their n their their uh their name and information in the record. Uh that L sixteen is is open green space. You know, our experience with these type developments um, you know, we put forward what we thought is was a good faith effort of what w we envisioned this process. [1:10:11, 1:10:31]: to be, but there's always groom uh room and uh for feedback. We appreciate the community's concerns. We're willing to consider those. We're gonna address the questions that were asked directly, but that that area that was was called out is is a green space. It could potentially be a dog park, but as [1:10:31, 1:10:45]: As of right now, it's green space and there's still room for feedback, you know, from a marketing standpoint and also what the community may want to see. Um Mr. Harris, the developer, wanted to address a couple of issues. [1:10:45, 1:10:50]: Yeah, I wanted to answer um a couple of questions uh um concerning the um [1:10:51, 1:11:01]: the dog uh excrements or pet excrements. Uh typically in a a project this size, uh, you know, you find them in town and, you know, we're considering [1:11:01, 1:11:21]: um downtown corridor of of uh stock bridges in town. And so you'll typically in these kind of uh projects, they have poop bins and the owners normally will have poop bins with with bags and they'll pick up the poop and put and uh put it into the bins. And uh that is also uh you know uh the H [1:11:21, 1:11:22]: H O A w handle. [1:11:23, 1:11:30]: getting that into the uh the bins to pick up be picked up. So that's typically how that works in these kind of uh um [1:11:30, 1:11:48]: in these kinds of communities. Also the community is also within a half mile of a park. So um tip and that's one of the you know good things about this community is they you know the the homeowners can walk to the to the park and walk their dogs uh and everything. Uh concerning the um the neighbors, um [1:11:49, 1:12:09]: We are asking for variances to reduce the side setbacks, but we will put sufficient um typically we always put uh sufficient barriers there, buffers, uh, whether it's different uh heights of trees, bushes, um, fences, to make it less is uh as less intrusive. [1:12:09, 1:12:12]: to the neighbors as possible. [1:12:12, 1:12:14]: And uh uh [1:12:14, 1:12:34]: Again to answer uh the other question is we typically the buyer for this type of uh product is different than a buyer who's looking for a single family home. It's usually again it's like uh usually professionals, uh young professionals. Um normally don't have kids, so they're not really worried about too much uh yard. Um [1:12:34, 1:12:35]: Um [1:12:35, 1:12:39]: And you know, they like to walk, they l they want to go to the amphitheater, they want to walk to a downtown [1:12:40, 1:12:52]: uh the parks. And so um you know they uh the the lack of yard is typically not a problem with the uh the buyer uh who would buy this particular project uh product. [1:12:55, 1:12:55]: Thanks. [1:12:58, 1:13:01]: Again, Regis Savan, one thirty nine Bayberry Hills. Um [1:13:02, 1:13:03]: I think um [1:13:04, 1:13:07]: This area is changing and it's changing rapidly. [1:13:08, 1:13:15]: It's no longer where you have the house on two acres of land, not in a downtown area. [1:13:15, 1:13:34]: Again, we're in the process of developing downtown stockbridge. This is what the city say they want. They want density in the downtown area, and this is what we're trying to bring. Uh in terms of the amenities, there's absolutely no need to duplicate. We have a park literally right across the street. [1:13:35, 1:13:45]: We have a baseball park, we have walking trails. We've also committed to doing the ten foot trails, uh I'm sorry, ten foot sidewalks for connectivity. [1:13:46, 1:13:52]: We're less than a quarter of a mile away from the amphitheater. Again, this is downtown. This is not in [1:13:52, 1:13:53]: Rule. [1:13:54, 1:13:58]: Henry County. This is downtown Stockbridge, where we're trying to bring [1:13:58, 1:14:00]: Density to the area. [1:14:00, 1:14:03]: And in terms of the question of why not let [1:14:03, 1:14:08]: someone put two homes on that piece of property, they're more than welcome to. [1:14:08, 1:14:10]: It's for sale as of tonight. [1:14:10, 1:14:12]: If somebody wanna buy it and put two homes on it. [1:14:13, 1:14:33]: We'll accommodate that. But right now, we're trying to bring density to the downtown area. And again, for those who support it, we certainly appreciate you. For those who don't support it, I hope that you take a moment to think about what we're trying to do. It's only going to enhance the area. And again, I hope you take a moment. [1:14:33, 1:14:36]: moment and just think about what we're trying to do. Thank you. [1:14:37, 1:14:38]: Thank you, gentlemen. [1:14:45, 1:14:46]: Is there anyone else? [1:14:48, 1:14:49]: On the opposition side. [1:14:51, 1:14:53]: Ma'am, you've already spoken. [1:14:53, 1:14:54]: I'll speak. [1:15:03, 1:15:10]: My name's Gary Lee and um I live in McDonough, but I have properties in Stock Ridge just like um [1:15:10, 1:15:16]: The applicant, I'm an investor. I have plenty of properties. I buy all the time. I buy in the city of Stockbridge. [1:15:17, 1:15:21]: Um one reason why I buy in the city of Stockbridge is because. [1:15:21, 1:15:25]: of the Waystop Bridge is and what it could be. And I do understand that. [1:15:25, 1:15:28]: I'm also a licensed broker. I understand density. [1:15:28, 1:15:30]: I understand trying to conform. [1:15:30, 1:15:31]: However [1:15:32, 1:15:34]: Everything on this plan does not conform [1:15:35, 1:15:38]: To the stop bridge and what y'all are trying to do. [1:15:39, 1:15:40]: If anything [1:15:40, 1:15:42]: Yes, the property could be for sale. [1:15:42, 1:15:46]: is to take the property that's on it now and just like other owners have [1:15:47, 1:15:50]: turn it into O and I or Office. [1:15:52, 1:16:03]: Go through, renovate the property, turn it into a law office, turn it into a I think there's a uh shop up the street, right next to the amphitheater. Couple of problems with this is with your setbacks. [1:16:03, 1:16:04]: So short. [1:16:05, 1:16:11]: People in the 300 range, which he said he's gonna start, so it's probably gonna end up about three fifty, three seventy five. [1:16:12, 1:16:28]: The people that can afford that type of price, they're not gonna have small cars. They're gonna have larger SUVs. Well, those larger SUVs are not gonna be parked in the garage because the garage are gonna be too small, so they're gonna be parked in the driveway, which they're gonna hang over the sidewalks, which people are gonna park on the street. [1:16:28, 1:16:32]: Which the HOA is not gonna do anything about it because everybody's gonna be parking on the street. [1:16:33, 1:16:40]: So with that being said, you're not gonna have a way for the garbage trucks to go in. You're not gonna have a way for the fire trucks to go in. [1:16:40, 1:16:43]: If you're talking about people want to walk everywhere, that's great. [1:16:44, 1:16:47]: So they get to cross East Atlanta Road to get to the park. [1:16:49, 1:17:05]: They can go to the amplitude, yeah, it's a quarter mile down the road on the same side. But now you need to add crosswalks or a red light, or they have to walk all the way down past the BP station in that area to get to a park or to publics or wherever else you want to walk. So now we're putting pedestrians on East Atlanta Road. [1:17:05, 1:17:07]: Which we all godly know. [1:17:07, 1:17:10]: I don't care what the speed limit is, everybody's running eighty five through there. [1:17:11, 1:17:12]: So [1:17:12, 1:17:24]: besides being a danger where people are in the subdivision, you can't get in and out because of the cars parked, now you're asking to walk down the street and try to cross to a park because they don't have no yard. [1:17:24, 1:17:33]: They can't go into the neighbor's yard, even though there's not really a plan for any type of berm or anything between'em. So they technically could play in the woods. [1:17:34, 1:17:35]: On other people's property. [1:17:35, 1:17:37]: So either way [1:17:37, 1:17:41]: I think it's a great idea, but it's just it doesn't fit right there. [1:17:41, 1:17:51]: It's just it's just too much trying to slam into that little area. I get the density, I get trying to make the money as an investor to put as many as you can on an acre. [1:17:53, 1:17:56]: But changing, getting variance after variance after variance. [1:17:56, 1:17:59]: Once y'all are out of office down the road, you're correct. [1:17:59, 1:18:02]: Twenty years from now, I'm still gonna be here. I'm gonna have to deal with that. [1:18:03, 1:18:04]: It's not gonna be fun. [1:18:05, 1:18:06]: Thank you for your time. Thank you, sir. [1:18:09, 1:18:10]: Oh. [1:18:10, 1:18:12]: This bring the public hearing to a close. [1:18:15, 1:18:22]: Uh Mr. Chairman, uh I think the young lady had one question that was never answered, and it's the garbage pickup. [1:18:24, 1:18:29]: Think she related to that also. Could could you get them to answer that question for her? [1:18:30, 1:18:35]: Sure. Mr. Sylvain, Mr. Gideons. [1:18:40, 1:18:42]: Did you understand what they're asking for? [1:18:42, 1:18:43]: Yes. [1:18:43, 1:19:03]: Um so typically um there's individual bins uh for each unit, but you know, we want to work with the community and and uh we're open to um you know a uh a trash uh uh community trash bin uh which you know there's space in the back of the uh development. [1:19:03, 1:19:16]: where we could put a community trash bin also. But typically there's individual bins for each in uh unit and they uh they would typically keep them in the driveway uh of the of the um prod property. [1:19:21, 1:19:23]: Does that answer your question, Ms. Field? [1:19:30, 1:19:41]: And those are all things that you know that can be written into the HOA uh docs to handle p and that's typically how the how it's done. Uh HOA is responsible for the uh pest control. [1:19:41, 1:19:55]: um the maintenance of the of the um property, uh enforcing the um the bins to not be overfill filled, all those kind of things are uh typically enforced by the uh HOA. [1:19:55, 1:19:56]: Very good. Thank you, sir. [1:20:01, 1:20:02]: Public hearing is now closed. [1:20:08, 1:20:16]: I will entertain a motion from the commission regarding comprehensive plan amendment KCP twenty twenty-three-o eight. [1:20:17, 1:20:23]: Mr. Chairman Dave Planchon, I would like to make a motion that we approve the comprehensive plan amendment. [1:20:24, 1:20:27]: CP twenty twenty three dash oh eight. [1:20:28, 1:20:30]: And I'm Harold, I'll second it. [1:20:30, 1:20:46]: It's been moved and seconded that we approve the comprehensive plan amendment number CP twenty twenty three dash oh eight. All in favor, let it be known by the sound of aye. Aye. Aye. Aye. [1:20:47, 1:20:48]: In your post? [1:20:49, 1:20:49]: Opposed. [1:20:51, 1:20:55]: We have three three ayes, one nay. [1:20:56, 1:21:04]: Mr. Mitten opposes it. Mr. Williams, Mr. Thibodeau, and Mr. Planchon is in favor of it. [1:21:07, 1:21:12]: So the eyes have it. The amendment case is [1:21:13, 1:21:14]: approved. [1:21:17, 1:21:22]: Now we'll entertain a motion for rezoning case R Z twenty twenty three dash oh nine. [1:21:27, 1:21:38]: Mr. Chairman, if nobody else will, this is Dave Planchon. I'd like to make a motion we approve the rezoning request twenty twenty three dash oh nine. [1:21:39, 1:21:40]: Is there a second? [1:21:42, 1:21:43]: Maharrow, I'll second it. [1:21:45, 1:22:00]: It's been moved and second that we approve rezoning case RZ twenty twenty three-zero nine. All in favor, let it be known by the sound of aye. Aye. Uh any opposed? Opposed. [1:22:01, 1:22:05]: The eyes have it. The rezoning case is approved. [1:22:06, 1:22:11]: For the record, Miss Secretary, Mr Williams, Mr Thibodeau, and Mr Planchon voted [1:22:13, 1:22:13]: Yay. [1:22:15, 1:22:17]: Mr. Minton voted nay. [1:22:23, 1:22:29]: I will now entertain a motion for variance case VR twenty twenty three dash zero five. [1:22:34, 1:22:36]: Mr. Chairman, Dave Planchon again. [1:22:37, 1:22:40]: Would like to make a motion that we approve variance request. [1:22:41, 1:22:43]: twenty twenty three dash oh five. [1:22:43, 1:22:55]: Is there a second? Um Harold, I'll second it. It's been moved and second that we approve variance case vrr dash 2023-05. [1:22:55, 1:22:57]: All in favor let it be numb by the sound of a. [1:23:00, 1:23:01]: In our post. [1:23:01, 1:23:03]: No. Pose, no. [1:23:06, 1:23:07]: We have [1:23:08, 1:23:13]: Two yeas and two nays, so I guess that means I need to cast a vote. [1:23:16, 1:23:17]: And I vote nay. [1:23:23, 1:23:24]: So the motion fails. [1:23:34, 1:23:36]: Did you get that, Miss Secretary? [1:23:40, 1:23:41]: Two to two. [1:23:41, 1:23:50]: Williams and uh Mitton voted nay, Thibodeau and Planchon voted yay, and I broke the tie with a nay vote. [1:23:53, 1:23:53]: Thank you. [1:24:02, 1:24:12]: The next case on the agenda is regarding property located on the north side of North Henry Boulevard and west side of Center Street. [1:24:13, 1:24:22]: Comprehensive plan amendment K C P Dash 2023 dash zero nine located in Council District Four. [1:24:24, 1:24:37]: The consideration of a request for a comprehensive plan amendment to change the future land use designation of a certain property on the north side of North Herman Boulevard and the west side of Center Street. [1:24:38, 1:24:52]: as listed below from low density mix use and medium density residential to medium density residential to allow for construction of a town home development. [1:24:53, 1:25:05]: The applicant is four star USA Real Estate Group Incorporated, represented by Alexander J. Alexander Brock or Smith Gambriel and Russell, LLP. [1:25:53, 1:26:13]: The second property is located at forty eight eighty two North Henry Boulevard, parcel S eighteen zero two hundred two zero zero five contains one point nine acres more or less. Existing future land use designation is L D. [1:26:13, 1:26:16]: DMU low density mixed use. [1:26:17, 1:26:21]: The third parcel is forty nine hundred North Henry Boulevard. [1:27:42, 1:27:42]: [5268.3, 5271.4]: The rezoning case for that same property [1:27:52, 1:28:06]: It's RZ twenty twenty three-one zero. It's located in Council District Four. It's consideration of request for a rezoning to rezone certain property. [1:28:07, 1:28:13]: on North Henry Boulevard, on the north side, and the west side of Center Street. [1:28:16, 1:28:18]: From suburban residential [1:28:19, 1:28:24]: office industrial and neighborhood commercial. [1:28:25, 1:28:29]: They want to rezone it to multifamily residential. [1:28:29, 1:28:32]: to allow for the town home development. [1:28:34, 1:28:37]: To allow for the construction of a town home development. [1:28:38, 1:28:43]: The applicant is four star or four star USA real estate group. [1:28:45, 1:28:52]: Again represented by J. Alexander Brock of Gamma Smith Gambriel Smith Smith Gambrel and Russell L L P [1:28:55, 1:29:00]: And then there's a variance case VR dash twenty twenty three dash oh six. [1:29:02, 1:29:07]: Is the consideration of a request for a variance on certain property [1:29:08, 1:29:14]: On the north side of North Emory Boulevard, the west side of Center Street, as I've already mentioned. [1:29:16, 1:29:20]: To allow for town to home development, the purpose of the variance [1:29:21, 1:29:25]: is to reduce the front yard setback [1:29:26, 1:29:28]: Of the proposed town home lots. [1:29:30, 1:29:34]: From the required fifty quift feet to thirty feet. [1:29:37, 1:29:41]: Under the requested multifamily residential zoning. [1:29:42, 1:29:51]: Again, the applicant is four star real estate group, represented by Hilth Gambattle Russell LLP. [1:29:56, 1:29:57]: Maybe we hear from staff, please. [1:30:10, 1:30:20]: This is a joint presentation for all three cases that were just named. Um these are proposed uh townhomes on the north side of North Henry Boulevard and the west side of [1:30:21, 1:30:22]: Center Street. [1:30:22, 1:30:24]: Applicant is four star real estate group. [1:30:25, 1:30:39]: So they submitted uh applications for uh comprehensive plan case number CP twenty twenty three oh nine, rezoning case number twenty RZ twenty twenty-three ten, and variance case twenty twenty-three oh five. [1:30:40, 1:31:00]: Um there are fifteen point six oh one total acres, five parcels of of them. It has five parcels and um actually actually uh four of them are are off North Henry Boulevard and one of them is uh has is broken down into two tracks with a large um track at the rear. [1:31:00, 1:31:02]: Yeah. [1:31:02, 1:31:07]: Forty nine hundred North Henry Boulevard and that tract has uh about ten acres. [1:31:07, 1:31:11]: The other parcels have only about one or two acres each. [1:31:13, 1:31:21]: Um so there would be proposed ninety town home units, density would be five point uh seven six nine units per acre approximately. [1:31:22, 1:31:23]: Um [1:31:23, 1:31:32]: Right now there's a funeral home and garage apartment at 4844 and 4882 North Henry Boulevard and vacant land on the other parcels. [1:31:36, 1:31:46]: We have surrounding uh land uses. We have the Stockbridge Takeway Do Academy and Club Drive subdivision to the west, vacant land to the north. [1:31:46, 1:31:49]: Um Holly Salon and Maris Bank to the east. [1:31:49, 1:31:50]: Um [1:31:50, 1:31:51]: Property is bounded to [1:31:52, 1:31:58]: bound to the south by North Henry Boulevard and then we have the Oak Hill and Mant turning point subdivisions to the northeast. [1:31:59, 1:32:05]: Um surrounding zoning, we got office institutional, suburban residential, and C One Neighborhood Commercial. [1:32:06, 1:32:06]: Um [1:32:07, 1:32:08]: existing [1:32:08, 1:32:12]: Applicant wants to rezone to MFR multiple family residential [1:32:12, 1:32:13]: And um [1:32:14, 1:32:18]: All but the rear of Forty nine hundred uh forty nine hundred North Henry Boulevard lie within the [1:32:19, 1:32:21]: Parkway mixed use overlay district. [1:32:21, 1:32:22]: Um [1:32:23, 1:32:34]: We have the applicant also wants to change a land use designation from low density, mixed use, and medium density residential to combine all all of them into just medium density residential. [1:32:36, 1:32:38]: This is a vicinity map of the area. [1:32:38, 1:32:41]: Can see here the large parcel largest parcel in red. [1:32:41, 1:32:50]: Um the smaller parcels uh down below and um uh to all to the north of North Henry Boulevard and then to the west of Center Street. [1:32:53, 1:32:58]: Here's the aerial photo or the neighborhood map, close up view of the surrounding streets. [1:33:00, 1:33:08]: And uh the aerial photograph again um this labels each of the addresses and each of the parcel numbers. [1:33:09, 1:33:14]: This is a l uh zoning and overlay districts map. You can see here in the yellow you have the [1:33:14, 1:33:17]: The S R suburban residential district. [1:33:18, 1:33:18]: Um [1:33:19, 1:33:24]: We have in in the pink and red areas, uh C one commercial and C two. [1:33:24, 1:33:27]: Um and then a blue is office institutional. [1:33:28, 1:33:29]: We have uh in the brown [1:33:29, 1:33:32]: In this area, the um MFR um [1:33:33, 1:33:38]: Multiple family residential, that's what the applicant is seeking to rezone the entire property to. [1:33:39, 1:33:41]: This is the future land use map. [1:33:41, 1:33:46]: And uh we have um medium density residential uh uh properties. [1:33:46, 1:33:58]: along North Henry Boulevard in the pink and low density residential uh or I'm sorry, mix uh mixed use in the pink and low density residential in the orange. [1:34:03, 1:34:23]: This is a boundary survey of the property. The important thing is to see is here the northern uh part of the property. There is Brush Creek uh bounding the property and its associated floodplains. And therefore, because of their presence, that limits the somewhat limits the developability of the site. [1:34:25, 1:34:45]: Um so again ninety townhomes would all would have three bedrooms. Their amenities include a pool, cabana dog park, and open space. Um the main entrance would be from North Henry Boulevard, and there would also be an emergency access to the northwest off Club Place, but that would be closed. [1:34:45, 1:34:53]: To the public, only used by fire trucks and ambulances, for instance. [1:34:53, 1:34:54]: Um [1:34:54, 1:34:57]: There was a traffic um [1:34:57, 1:35:00]: Not a full traffic impact study d done, but um [1:35:00, 1:35:06]: Estimate calculations made that there'd be about forty trips in the morning produced and forty seven in the afternoon. [1:35:07, 1:35:21]: This is not expected to be significant because North Henry Boulevard's a principal arterial. Um there would also be a stormwater pond and seventy-five foot floodplain buffer at the rear, twenty-five foot zoning buffer surrounding the property. [1:35:21, 1:35:23]: Three hundred sixteen parking spaces. [1:35:24, 1:35:27]: meets the requirements, also includes forty two guest spaces. [1:35:28, 1:35:31]: Thirty percent of the site would be open space that meets the requirements. [1:35:31, 1:35:32]: Um [1:35:33, 1:35:38]: There will be about town there'll be thirteen town home buildings, space at least twenty feet apart. [1:35:38, 1:35:44]: Uh the requested variants will reduce the front yard setbacks of lots from fifty to thirty feet. [1:35:44, 1:35:53]: The lots would be twenty four feet wide for two garage units and twenty feet wide for one car garage uh one one car garage units. [1:35:55, 1:35:58]: Uh here's a conceptual site plan. [1:35:58, 1:36:04]: Uh again it shows the main axis off N North Henry Bull with a cul-de-sac and then two cul-de-sac actually [1:36:05, 1:36:15]: And then the amenity areas would be here in this area, the pool, uh uh cabana dog park and another stormwater detention pond. That's a close up here. [1:36:16, 1:36:18]: Uh I have it also on a separate file [1:36:18, 1:36:22]: The site plan itself, if anyone needs to see an enlargement. [1:36:22, 1:36:27]: Um these are details about the site data, and a lot of it covered this already. [1:36:27, 1:36:30]: Here's the diagrams of proposed townhome lots. [1:36:30, 1:36:31]: Um [1:36:31, 1:36:34]: Showing the larger units, uh twenty [1:36:35, 1:36:38]: Four feet wide and a and the smaller units twenty feet wide. [1:36:40, 1:36:48]: So these are sample renderings. These are the units with the one car garages and these are the ones with the two car garages. [1:36:49, 1:36:55]: Now I'm gonna talk about our analysis for comprehensive plan amendment case number CP twenty twenty three oh nine. [1:36:55, 1:36:58]: So um we have existing par um [1:36:58, 1:37:06]: Designation of low density mixed use allows low intensity mixed uses to serve serve the surrounding residential neighborhoods. [1:37:06, 1:37:08]: Um the rear par track [1:37:09, 1:37:14]: The large parcel is designated as medium density residential that allows single family detached homes. [1:37:15, 1:37:16]: And and townhomes. [1:37:16, 1:37:17]: Um [1:37:17, 1:37:23]: Applicant wants to change that rear parcel so that all five parcels have the same medium density residential designation. [1:37:24, 1:37:25]: Um [1:37:25, 1:37:29]: We found that the density would be acceptable and um [1:37:29, 1:37:35]: There's already large areas to the east and west with the same designation of medium density residential. [1:37:35, 1:37:37]: And this development will provide [1:37:37, 1:37:40]: needed housing uh in the city. [1:37:40, 1:37:43]: and diversity in housing and that's what the conference uh plan p calls for. [1:37:44, 1:37:46]: We conclude at the [1:37:46, 1:37:49]: The comprehensive plan amendment request is reasonable. [1:37:49, 1:37:51]: And recommend approval of that. [1:37:52, 1:37:54]: Now I'm gonna talk about the rezoning case. [1:37:54, 1:37:59]: Um proposals to rezone the property from S R O I and C one to M FR. [1:38:00, 1:38:03]: We found that it's consistent with sub comprehensive plan, as I just mentioned. [1:38:04, 1:38:12]: It is located on a road having a classification of collector or higher. We have other compatible MFR districts nearby. [1:38:12, 1:38:17]: Property is suitable, although it has the irregular shape and if loadplain areas they [1:38:17, 1:38:23]: Applicants designed the site plan in a way to avoid those areas or or to compensate for them. [1:38:24, 1:38:24]: Um [1:38:25, 1:38:33]: There should be minimal access on the Jerson property owners because of only one main access and and no through streets going through. [1:38:34, 1:38:40]: Um they s applicant submitted a letter from public works. There is adequate water and sewer capacity. [1:38:41, 1:38:43]: They just need to meet uh public works. [1:38:43, 1:38:44]: Um [1:38:44, 1:38:45]: Uh [1:38:45, 1:38:46]: Send uh [1:38:47, 1:38:50]: prepare construction plans to that office within one year so that [1:38:51, 1:38:52]: capacity will be reserved. [1:38:53, 1:38:56]: I talked about traffic impacts should be minimal. Um [1:38:58, 1:39:04]: Uh property could be developed under the z existing zoning, but that would be piecemeal development. This uh [1:39:05, 1:39:08]: design would allow for a com unified plan. [1:39:10, 1:39:11]: Okay. [1:39:12, 1:39:22]: So we conclude that the proposed rezoning is reasonable and uh should be approved with the following conditions based on the site plan that was submitted or a similar one. [1:39:23, 1:39:23]: Um [1:39:24, 1:39:26]: Uh access and streets. [1:39:26, 1:39:30]: Applicant developers shall comply with the requirements of the city's fire marshal [1:39:30, 1:39:36]: And also comply with the uh requirements of public works regarding utilities, installations. [1:39:38, 1:39:39]: Uh further [1:39:39, 1:39:48]: Further uh conditions are waste collection. There should be a consolidated waste collection system with no individual waste receptacles being permitted. [1:39:49, 1:39:52]: Architectural design, three of them we identified. [1:39:52, 1:39:55]: All town home units shall have brick on at least three sides. [1:39:56, 1:40:02]: Secondly, at least eighty percent of townhome units shall have two car garages. And thirdly, this shall be a gated community. [1:40:03, 1:40:10]: Rental units, there should be no more than ten percent of of the town home units rented at any one time. [1:40:10, 1:40:20]: Property maintenance. Um, developer must create a townhomes association similar to an HOA or secure property management company to maintain all common areas. [1:40:20, 1:40:23]: Developers shall also take appropriate steps. [1:40:23, 1:40:24]: Preserve. [1:40:24, 1:40:25]: Rush Creek. [1:40:26, 1:40:29]: and adjacent floodplain areas for environmental protection. [1:40:30, 1:40:35]: Now I'm gonna talk about variants case number V R twenty twenty three oh five. Again this was [1:40:36, 1:40:37]: Proposal to reduce [1:40:37, 1:40:41]: The front yard set back from fifty to thirty feet under the MFR. [1:40:42, 1:40:42]: Zoning. [1:40:43, 1:40:49]: So there are certain criteria for that. I'll just go through them briefly. Yes, the property has extraordinary circumstances. [1:40:49, 1:40:53]: Because of its irregular shape and the presence of the floodplain areas and creeks. [1:40:54, 1:40:57]: Um this may be caused the applicant difficulty. [1:40:58, 1:40:59]: uh in designing the site. [1:41:00, 1:41:03]: It would not grant any special privileges on the property owner. [1:41:04, 1:41:08]: Um it would be consistent with the UDC on compatible neighboring [1:41:09, 1:41:09]: Uh [1:41:09, 1:41:11]: uses um [1:41:12, 1:41:18]: And um none of this is these circumstances are result of the actions of the applicant. [1:41:19, 1:41:21]: And the last few um [1:41:21, 1:41:25]: This uh property, although it could be developed with adjacent uses. [1:41:25, 1:41:27]: Again, this would bring a cohesive plan. [1:41:28, 1:41:28]: And um [1:41:29, 1:41:34]: And otherwise would be the uh developer will be c uh very much uh constrained. [1:41:34, 1:41:35]: Um [1:41:35, 1:41:39]: And this is townhomes are permitted use in the MFR district. [1:41:40, 1:41:45]: We therefore think that this uh ta variance request is reasonable and re recommend its approval. [1:41:47, 1:41:52]: And that's that's my uh presentation for all three cases. [1:41:52, 1:41:53]: Thank you, Lynn. [1:41:57, 1:42:02]: My fellow commissioners, do you have any questions for Mr. Logan? [1:42:08, 1:42:09]: No questions? [1:42:12, 1:42:13]: Thank you, Linda. [1:42:17, 1:42:18]: Is the applicant present? [1:42:56, 1:42:57]: Excuse me. [1:42:57, 1:43:17]: Good evening, Mr. Chair and members of the Planning Commission. My name is Alex Brock with Smith Cambrell Russell. Here on behalf of FourStar Real Estate Group, and with me tonight I have Jack Burke and Ren Giazzoni with FourStar. And we are here to discuss our applications for a comprehensive plan amendment rezoning in one variance total. [1:43:17, 1:43:21]: allow a town home development on North Henry Boulevard. [1:43:21, 1:43:41]: The property is located approximately a third of a mile uh east of this uh facility on North Henry Boulevard in between uh Center Street and uh Club Drive. Uh you can see Clubs. Club Drive uh to the east and then Center Street uh to the west. [1:43:43, 1:43:46]: Uh or I have that backwards, sorry. Um [1:43:46, 1:44:06]: The current zoning of the property, as staff mentioned, I'm not going to go through their uh presentation. I think Ms. Slogan did a very thorough job of explaining the facts of the case, but there are a few things that I would like to mention. Uh the properties now uh consists of five parcels. They all have uh various zonings, uh O and I. Um [1:44:09, 1:44:29]: Excuse me, O and I, S R and C one. Uh we would like to rezone the entire property to MFR to allow cohesive zoning and development of the property for 90 townhome units, uh, as well as a comprehensive plan amendment to allow the MFR zoning. Uh currently the four parcels along North Henry Boulevard are [1:44:29, 1:44:45]: are in the low density vertical mixed use land use, and then the larger parcel to the north is in the medium density residential district. And surrounding the property to the north, east, and west are other districts within the MDR district. [1:44:47, 1:45:07]: Uh the proposed unit we are proposing 90 units, uh mixture of 20-foot wide units and 24-foot wide units. Uh currently the design calls for 43 uh 20-foot one-car uh garage units and 47 two-car uh 24-foot wide units. Uh the amenities we will we are proposing. [1:45:07, 1:45:12]: Proposing a pool along with a clubhouse and dog park. Um [1:45:12, 1:45:16]: The pool and clubhouse will be located in this area, uh dog park down here. [1:45:17, 1:45:29]: And this is something that we've gotten from input from the city on previous rezonings in the city of Stockbridge. They wanted to see more amenities, so we went ahead and included that up front with our initial design of the property rather than waiting for the city to comment on that. [1:45:31, 1:45:51]: As Ms. Logan mentioned, uh, our access will be from North Henry Boulevard, uh, which is a Georgia DOT controlled right-of-way. Uh it is a principal art arterial uh with a high volume of traffic. And we will have a secondary entrance to the north off of Club Place. That will be gated and locked for emergency access only. It will have an uh what they call an Oxbox. [1:45:51, 1:45:54]: [6355.0, 6359.2]: And that will only be used during uh emergency uh situations. [1:46:05, 1:46:25]: The the rezoning to MFR, it's compatible with the surrounding zonings. To the west and to the north, uh to the north there's an undeveloped parcel owned by the city of Stockbridge zoned SR. Uh to the uh west along uh Club Drive and Club Place are single-family uh detached homes zoned SR. [1:46:25, 1:46:26]: But to the [1:46:26, 1:46:29]: А іст овер ви [1:46:30, 1:46:50]: Several developments. The Oak Hill Terrace Town Home community down here, which is zoned MFR, the same dis or the same zoning that we are requesting. And that is approximately 16 units at a density of six point seven or six seven units per acre. Uh the turning point subdivision just to the north here uh is zoned SR, but that is forty-five units. [1:46:50, 1:47:03]: at a density of 8.07 uh units per acre. Our density, our proposed density is below both of those. We are requesting a density of 5.77 units per acre. [1:47:03, 1:47:16]: Uh so that will act as a compatible transition between the denser residential to the east uh uh to the existing uh s uh single family detached residences to the west. [1:47:18, 1:47:24]: And as I mentioned earlier, the property is located just north of the city's down downtown amphitheater. Um [1:47:25, 1:47:38]: across the parking lot from where we are tonight. Uh and it's also just south on North Henry Boulevard of a large commercial node at 138 where you have the existing Walmart and a number of other commercial developments. [1:47:41, 1:47:50]: In addition, the townhomes are aligned with Stockbridge's long-term planning documents, uh, in particular the uh city's newly adopted comprehensive plan. [1:47:51, 1:48:04]: In the comprehensive plan, there's uh a repeated note of the city's desire and need for a mixture of housing and diversity of housing types. We are proposing uh a townhome development at a [1:48:05, 1:48:25]: relatively lower density uh than what you see in other townhome developments with a number of amenities uh to fit within the area. Uh our goal and what our intended market is will be uh younger professionals and uh empty nesters. Those are the typical market for these types of townhome developments. Uh and the reason for that is [1:48:25, 1:48:40]: people tend tend to like townhomes because of the uh lack of yard maintenance. Four star will have an hoa that will m maintain not only the common areas but also the maintenance within the lots as well. [1:48:42, 1:48:58]: Uh community engagement. We did have a community meeting with the surrounding neighbors. Uh we sent out approximately forty five notices. Uh we had uh approximately ten people join a Zoom meeting last night. Uh I believe some of those may be in attendance uh here tonight as well. [1:49:00, 1:49:07]: There was a number of uh items discussed uh to get a better idea of how the emergency access was handled. Um [1:49:09, 1:49:29]: There's questions on stormwater uh buffers. We do have a twenty-five foot buffer along the SR zoned uh properties. Since the Oak Hill Terrace townhomes are also zoned MFR, we're not required to have a twenty-five foot buffer, but we are meaningful to extending that buffer further south uh in in planning uh that they're just [1:49:29, 1:49:35]: to add to it, but we do have a large amount of space between the back of the townhomes and the adjacent properties. [1:49:36, 1:49:47]: You that is uh as far as a twofold purpose. One, uh it helps buffer the adjacent properties. Uh there's approximately almost four hundred feet between the back of our homes and the back of the [1:49:48, 1:49:50]: Homes on uh club drive. [1:49:50, 1:50:06]: So there's this significant amount of vegetation that's there. And also with that uh space be behind our homes, we can preserve a lot of that for vegetation or re-vegetate it. The the site does have quite a bit of a topography. It drops to the south, uh down towards the creek. [1:50:07, 1:50:13]: So we anticipate that there will be grading, uh, but we're willing to uh uh plant back behind the homes. [1:50:16, 1:50:24]: Uh uh that goes into our one variance request uh for shorter uh front yard setback. [1:50:24, 1:50:44]: And the reason for that request, uh, the 50-foot setback is excessive for townhomes uh if you look at other jurisdictions. And we've also done other rezonings here in the city of Stockbridge and had a similar request, and that is just to shorten the driveway. We are we still maintain a 30-foot driveway uh in the front, which would allow a vehicle to be parked in front of the drive. [1:50:44, 1:50:55]: front of the unit. But it also moves the units away. This yeah as you can see it's a long narrow site and as I mentioned there are topography issues. [1:50:55, 1:51:01]: But it moves the units away from the adjacent residential, uh which adds to that buffer, uh buffering effect. [1:51:03, 1:51:23]: And uh also in addition to that, as I mentioned, uh Four Star is uh planning on having the HOA maintain the landscaping, uh not only in the common areas, but also in the uh lots themselves, the units themselves. Uh when you have a larger front yard, that just increases the cost of the HOA each month because they have more to maintain. [1:51:25, 1:51:33]: So with that, uh I'll end my presentation. Just note that staff has recommended approval of all three applications. Uh [1:51:34, 1:51:52]: Uh we did have a meeting with the community last night. There were some concerns. We hope we address those. There were some questions that we have to go back and look at. Um namely with the the buffer issues uh along the adjacent uh properties, but we are willing to have more engagement with the community after this if necessary. [1:51:53, 1:51:56]: Thank you, sir. Thank you. Any questions for the applicant? [1:51:57, 1:51:59]: Yes. Mr. Chairman. [1:52:00, 1:52:20]: Uh first thank you for the William go ahead sir. Thank you. Thank you for your presentation. Uh one I wanted to know, what was the price point starting for the town? It's in the 300s. Uh the sale of the property, the schedule that we're looking at now, if we successfully get through the rezoning of this, uh we would submit for LDP uh later the spring or in the summer. [1:52:20, 1:52:34]: with uh land disturbance beginning in 2025 and then uh the first units selling 2026, 2027 timeframe. So right now we are looking at 300s, uh, but that may change by the time we uh sell the units. [1:52:34, 1:52:45]: Okay. And then one more question. Um so the area that you guys are looking at, will there be a buffer between this development and club place, that street? [1:52:45, 1:52:51]: There is uh currently on the plan a twenty five foot buffer, but there's a larger uh [1:52:51, 1:53:02]: area between the back of our proposed lots and the property line as well. It's approximately 120 feet from the back of our units to the property line. Thank you. Thank you, Mr. Chair. [1:53:03, 1:53:05]: Mr. Planchon, you had a question. [1:53:06, 1:53:26]: Yes, m uh um since this is going to be a gated community, i are you aware that the you're going to be responsible for the roads and the HOA is going to be responsible for the roadways then? That that's correct. It would be a um a private drive. Uh so that's something that we weren't initially uh anticipating, uh but staff is [1:53:26, 1:53:46]: Has recommended that condition. Now we'll note to this uh body that we did receive the conditions on Monday. We've had our engineer look at a number of these to, particularly with the requirement for 80% two-car garages, because that does impact our site design quite a bit. Uh we have not come up with an answer to that yet, but we we are looking at all these whole lists. [1:53:46, 1:53:47]: statistically to see how it impacts our development. [1:53:48, 1:53:57]: Okay. And again I'm gonna repeat myself. Do you anticipate marketing these to s adults primarily or families [1:53:57, 1:54:11]: The that's the uh adults um both empty nesters and young professionals are the typical market for townhomes, uh not only on the south side of land but all over uh because of the lack of yard maintenance is is particularly attractive to those groups. [1:54:13, 1:54:13]: Thank you. [1:54:15, 1:54:16]: Any more questions for the Africa? [1:54:20, 1:54:20]: Thank you, sir. [1:54:20, 1:54:21]: Thank you. [1:54:22, 1:54:24]: Now I'll leave this up here for the [1:54:28, 1:54:40]: We'll now open the floor for public comments and I will entertain any comments that are in favor of this development at this time. [1:54:47, 1:54:48]: Seeing none. [1:54:50, 1:54:55]: I will now open it for comments that are in opposition to this development. [1:54:58, 1:55:06]: If you have not already done so, sir, fill out a form you have approach the podium, give us your name and let us hear your comments. [1:55:12, 1:55:32]: My name is Travis Powell. I uh my address that I put down is the address of the property that I own on Club Place that I was have been intending to move to eventually, but I actually live out on 138. I have a large property out there. Uh I don't really have a complaint about this because I've known [1:55:32, 1:55:52]: Known forever that this was coming. Uh I grew up here. I used to play in the woods there when I was little, all around. In fact, up the old cemetery that nobody knows about and so forth. Anyway, uh one of the things I had to comment about, uh, in fact, I think I brought it up last night about the revenue from [1:55:52, 1:56:12]: Tax revenue? I know that's one thing people won't, the city won't, so that's I think that's why y'all want to get larger so you can get more revenue, right? And I was asking them, are these lots are gonna be taxed both as property and uh improvements? In other words, will there be enough tax coming in from [1:56:11, 1:56:30]: From these uh townhouses to cover things like the sewage, uh schools, whatever. Uh anyway, the main thing I was thinking about was uh my property on Club Place. Um I'm [1:56:31, 1:56:39]: I'm on the s the low side of that street. And I used to have a berm at the top of my driveway to keep my property from flooding or my house from flooding. [1:56:40, 1:57:00]: And when they came in and repaved the road, they covered it up up to the top of my berm. So now, and I can almost guarantee you if I go over there right now, my garage is gonna be flooded. They've already flooded the whole basement. I had to rip out all the carpet. I don't live there yet. Like I said, I've been holding on to it. It was my ex-in-law's house. I acquired it when they passed. [1:57:00, 1:57:13]: Away because I took care of them. And at one point I was gonna, as soon as my mother died or my family died on the farm that I live on, I was gonna sell all that, remodel, and move into that house. [1:57:14, 1:57:34]: So I was concerned about there ev even though there's a limited access way at the end of the cul-de-sac that they talked about, I also wanted to make sure that because there is a downhill slope from all from the houses across the street, and I'm guessing through the woods down to [1:57:33, 1:57:45]: to that point to where it connects to club place, there's gonna be a large flow of water. And I'm afraid that's gonna be down Club Place into my driveway again. [1:57:46, 1:58:06]: Now once I move up here I may try to put a wall, you know, all the way along there across and put up an another berm. But I know I've had a lot of trouble with flooding just because there's so much rain coming down the hill from the neighbors across, across Club Place, because their backyards are basically straight up. They don't have yards, they have hills. [1:58:06, 1:58:26]: And I'm guessing this property here where the woods are are also one big hill. So as long as they divert it down into what they call their retention pond, which I'm not sure that's going to take care of all the flow downhill. And of course that'll end up going into what do you call it now? Brush Creek. You know, Brush Creek used to be a little bit. [1:58:26, 1:58:46]: To be basically the overflow for Askews Lakes, and that was the only water that came down. I grew up playing in that creek. It never was wider than four feet or six inches deep. And now it floods half my yard because so much water from the trailer parks, Walmart, all those businesses along. [1:58:46, 1:58:57]: have somehow been able to divert into that creek when it rains. So if you go down there when a hard rain comes, in 10 or 15 minutes that thing's gonna raise up six feet. [1:58:58, 1:59:13]: And it it's not gonna be long before you're gonna have to replace those tank those uh culverts under Club Circle also. So anyway, like I said, I don't really have a negative a anything negative to say about the development'cause I said it's gotta be coming. I just wanna make sure that [1:59:15, 1:59:35]: You know, the city is is getting their money's worth of from the taxes without it impacting any other people and anybody anybody else's taxes going up. I used to be a Stockbridge fireman, so I used to go to city council meetings and I remember back in the eighties when I when that apartment development just passed. [1:59:37, 1:59:40]: Well it's just pass uh Buchanan? No. What's that [1:59:40, 2:00:00]: chiropractors. Where the Gilberts used to live, the Gil Gilberts original house. Some people came in to to do the same thing they wanted to build as apartments. And right in the middle of the city council meeting they basically told him, Well, we'll pay you twenty thousand dollars to going towards your water treatment if you'll let us bill. [2:00:02, 2:00:05]: So I didn't want that something like that to happen, you know, where [2:00:05, 2:00:06]: There's something going on. [2:00:07, 2:00:12]: And see, I didn't even know about this. Was wasn't this supposed to be publicized either by signage? It was, sir. [2:00:13, 2:00:20]: Well why wouldn't I not have g received or the person next to me? I have no idea. Okay. But thank you for your time, sir. All right. Thank you. [2:00:24, 2:00:40]: Good evening again, uh Gary Lee. Um like I said before, I'm an investor, I own properties, and I don't really have an issue with it, but I never got notice. They said that they had a community meeting. I never and I I got notice and [2:00:40, 2:00:48]: I own two units right here, and I represent three more of my owners that are right here. So my biggest concern is. [2:00:49, 2:00:57]: With all of this here coming in, you're taking out all that vegetation, and to the point is [2:00:58, 2:01:18]: Here's your retention pond there, but everything on here runs from left to right. So when they clear all of this out, there goes all those trees, grass, you know, crap basically that's holding the water from flooding these units. So even though they're talking about there's 120 feet here, these properties on Club Drive. [2:01:18, 2:01:20]: [7280.9, 7286.1]: All their property is in their backyard. So you can see the house here. This is all their backyard. [2:01:27, 2:01:28]: My house sits right here. [2:01:29, 2:01:30]: I don't have a backyard. [2:01:31, 2:01:33]: I can go out and throw a stone and hit. [2:01:34, 2:01:35]: their townhouse once they build it. [2:01:36, 2:01:43]: So what we're worried about here is all of this here from the streets, the coverts, that's not called. [2:01:44, 2:01:46]: is you want to flood this area here. [2:01:48, 2:01:52]: Which at that point I'm gonna have a problem because mine's a slab unit. [2:01:53, 2:02:04]: Well actually the all slab units. And what they're talking about here is when they rezone to match everyone else, these townhomes here and even these here, these are not attached. [2:02:05, 2:02:11]: The zoning is correct, but there's no garages. They're twelve, thirteen, fourteen hundred square feet. [2:02:12, 2:02:20]: They're not 2,000 or 2,500 square feet, which you're talking here, with two-car garages and things like that. So these are much smaller units. [2:02:21, 2:02:26]: So even though the zoning is per acre, these are small units. [2:02:26, 2:02:30]: And so the surface area that they're using is less than what they're doing here. [2:02:31, 2:02:43]: And then you're gonna pull traffic right here, right across from the subdivision, I think it's called Tahoe Road. There's even where they egress and degress there, the reduction lanes. [2:02:43, 2:02:52]: You're gonna have people backing up trying to get in and out if it's a ghetto community. So if they're not using this entrance back here, you're gonna have people coming in and sitting on. [2:02:52, 2:02:55]: Um North Henry Boulevard trying to get in or out. [2:02:56, 2:03:01]: Let's say for good on a good day, everybody here has one car. That's 90 cars. [2:03:02, 2:03:08]: If half of'em go to work, that's forty-five cars trying to get out and get in on North Henry Boulevard. There's no light here. [2:03:10, 2:03:11]: There's no way for safety. [2:03:12, 2:03:18]: I mean it's already pretty bad there, even with thirty-five miles an hour in this zone, which is what they're talking about. People run sixty. [2:03:19, 2:03:23]: So again, even with the the other units, you're having problem with traffic. [2:03:23, 2:03:28]: Everything looks great on paper, but once you get in and actually looking at it, it's not gonna work. [2:03:29, 2:03:33]: That's not for me to decide, that's for you. I'm just worried about getting flooded out. [2:03:34, 2:03:35]: That's my biggest concern. [2:03:35, 2:03:35]: So [2:03:36, 2:03:37]: Thank you for hearing me out. Thank you, sir. [2:03:39, 2:03:39]: Next please. [2:03:47, 2:03:50]: А тери вайдо ливом окіл церкви. [2:03:51, 2:03:54]: the properties backs up right to us. [2:03:55, 2:03:59]: And I'm I'm not opposed to it. We just have a couple of concerns. [2:04:00, 2:04:05]: We already have a uh water runoff issue from the property. [2:04:05, 2:04:11]: above us running through the backyard and it's a fairly serious issue that we have. [2:04:11, 2:04:14]: Um and the other issue is [2:04:14, 2:04:19]: about um having uh enough of a buffer that [2:04:19, 2:04:21]: Ви стіль хав саморасі. [2:04:22, 2:04:34]: And also a well built privacy fence to keep any foot traffic from coming out of the development onto our properties'cause we back up right to the woods. [2:04:36, 2:04:43]: And that's the m that's the only two concerns that I have about it. It's that and also when they're doing the prep work. [2:04:44, 2:04:58]: 'Cause the w the property slopes towards us. So when they're doing prep work, we uh just make sure that the runoff is directed away from our properties, I'm not kill circle. [2:05:00, 2:05:07]: But um other than that, that's I mean I have no objection to it or just help us. Thank you. [2:05:08, 2:05:09]: Go ahead and answer. [2:05:09, 2:05:29]: I I think that uh you should get with the developer uh if this project is approved one way or the other and list all your concerns about the them grading the property. I have and uh Mr. Brock's taking it under consideration. I just wanted to [2:05:30, 2:05:40]: And any other neighbor that has concerns, everybody needs to get together to see what they can work out with a developer or a builder. [2:05:40, 2:05:43]: Okay. Thank you. Thank you. Thank you, sir. [2:05:45, 2:05:45]: In Mokhamess. [2:05:49, 2:05:52]: If there are no other comments, the public hearing is closed. [2:05:54, 2:05:56]: You can. Come right up, sir. [2:06:03, 2:06:23]: Thank you, Mr. Chair. It it just I'll keep this brief, uh, because we did meet with the number of these individuals last night. Uh but stormwater, we do have two stormwater ponds on the property. And we are required by not only state law but city ordinance as well to capture and reduce the uh flow of stormwater uh from our property. Just I can't hear you. Oh I'm sorry. [2:06:23, 2:06:43]: Is that better? Nothing better. Thank you. We do have two stormwaters on the uh stormwater ponds on the property, one towards uh North Henry Boulevard and then another one to the north uh closer to the creek, and that's just because of the topography of the uh site. But we are required by not only state law uh but city ordinance to capture and retain the stormwater. [2:06:43, 2:07:03]: and release it at a rate that is uh that will not negatively impact the downstream property. So that is something that we are required to do at this stage in a rezoning. Typically we don't have a hydrology study done, but that is something our engineer will look at. And Mr. Wade, uh to his point, he did email email me a list of his comments. We are actively looking at that. One of those comments [2:07:03, 2:07:07]: comments was um he lives in this unit over here. [2:07:07, 2:07:22]: off of Oak Hill Terrace. We are looking at additional buffering uh of the property uh to extend that twenty-five-foot buffer down, as well as uh privacy fencing uh along the uh uh property line with the pool uh to accommodate his request. [2:07:23, 2:07:23]: Or. [2:07:25, 2:07:26]: Are you? [2:07:29, 2:07:43]: Yeah, oh uh one other uh somebody did mention about traffic on North Henry Boulevard. We are proposing a D sell lane. Uh it that has to go through permitting with Georgia DOT since that is a state rideway. Uh but that is something that we are uh proposing to do. [2:07:44, 2:07:45]: Thank you, sir. [2:07:46, 2:07:46]: Thank you. [2:07:51, 2:07:52]: Public hearing is not closed. [2:07:54, 2:08:02]: Therefore I will entertain a motion on comprehensive plan case CP twenty twenty three dash zero nine. [2:08:05, 2:08:07]: I need a motion from commission, please. [2:08:07, 2:08:18]: Mr. Chairman, since these are all combined on one report, can we just take one vote and approve or deny all of them together or do you want to do them individually? I wanna do them individually. I need a motion, please. [2:08:22, 2:08:31]: Mr. Chair, motion to uh motion to approve comprehensive plan amendment case CP dash twenty twenty three dash oh nine. [2:08:32, 2:08:33]: And I'll second it, Harold. [2:08:34, 2:08:44]: It's been moved and seconded that we approve for the comprehensive plan amendment KCP twenty twenty three dash zero nine. Aye. All in favor, let it be known by the sound of aye. [2:08:44, 2:08:45]: Uh [2:08:46, 2:08:47]: Any opposed? [2:08:48, 2:08:48]: No. [2:08:50, 2:08:51]: Any abstentions? [2:08:53, 2:08:58]: Mr Williams, I didn't ma I you in favor? So there were three p three Ya's and one nay. [2:09:00, 2:09:03]: So the motion the uh comprehensive plan amendment case was approved. [2:09:08, 2:09:16]: With regard to rezoning case R Z twenty twenty three dash ten, I need a motion from the commission, please. [2:09:18, 2:09:19]: Mr Chair. Yes, sir. [2:09:20, 2:09:25]: Motion to approve rezoning case R Z dash twenty twenty three dash ten. [2:09:25, 2:09:28]: Is there a second? In Harrow, I'll second it. [2:09:28, 2:09:37]: Thank you. It's been moved in second that we approve the rezoning case RZ 2023-10. All in favor, let it be known by the sound of I. [2:09:37, 2:09:38]: I [2:09:39, 2:09:40]: Any opposed? [2:09:41, 2:09:41]: Okay. [2:09:42, 2:09:50]: We have three ayes and one nay. So the motion passes. Reads only case RZ 2023-10 is approved. [2:09:53, 2:10:00]: In various case R VR twenty twenty three dash oh six. I need a motion from the commission, please. [2:10:02, 2:10:08]: Mr. Chair. Yes, sir. Motion to deny variance case VR dash twenty twenty three dash oh six. [2:10:11, 2:10:22]: There's a motion to deny variance case VR twenty twenty three-0 six. Is there a second? Mr. Chairman, I second. It's been second by Mr. Mitten. All those in favor, let it be known by the sound of aye. [2:10:22, 2:10:23]: Uh. [2:10:23, 2:10:24]: Nay. [2:10:26, 2:10:32]: So there are three eyes and one nay for denial. So the variance case has been denied. [2:10:39, 2:10:41]: The vote was [2:10:43, 2:10:50]: For denial of the Varance case was Mr Williams, Mr. Thibodeau, and Mr Mitten. [2:11:00, 2:11:02]: Mr. Planchon up opposed. [2:11:05, 2:11:09]: Mr. Chairman, this is Dave Planchon. In case I'm missing something. [2:11:10, 2:11:13]: The variance case is twenty twenty three dash oh five. [2:11:15, 2:11:18]: I see it down here twice, not oh six. [2:11:20, 2:11:22]: What I'm reading says oh six. [2:11:25, 2:11:27]: Page four of the agenda. [2:11:29, 2:11:32]: Yeah, I'm looking at the combined report itself. [2:11:34, 2:11:37]: We have O nine as the [2:11:38, 2:11:45]: I'm reading from the agenda, sir. The agenda governs what's being conducted tonight. Okay. Thank you, sir. [2:11:51, 2:11:55]: Are there any project updates from staff or staff comments? [2:11:56, 2:11:56]: None. [2:11:58, 2:12:00]: Any comments from the board? [2:12:04, 2:12:06]: No comments from the board? [2:12:07, 2:12:10]: The meeting stands adjourned. Thank you. Have a good night.
