[0:06:55, 0:06:56]: [416.6, 418.2]: In your polls. [0:06:58, 0:07:00]: Does have it. The minutes are approved. [0:07:05, 0:07:15]: Next item on the agenda is a text amendment case, TX 2024-04 for housing shelters citywide. [0:07:16, 0:07:36]: The City of Stockbridge Mayor and City Council will hold a public hearing on Monday, June 10th, 2024, at 6 p.m. in the Stockbridge City Hall, located at 4640 North Henry Boulevard, Stockbridge, Georgia, to consider a proposed text amendment. [0:07:36, 0:07:40]: through the Stockbridge Unified Development Code, UDC. [0:07:41, 0:08:01]: To allow for the location of various types of housing shelters within the C two General Commercial, C three heavy commercial, and OI Office Industri Institutional and Lied Light Industrial Zoning Districts at special uses. [0:08:01, 0:08:07]: Requiring the approval of a special use permit through the public hearing process. [0:08:12, 0:08:15]: The case is to be presented by staff. Thank you. [0:08:16, 0:08:17]: Greetings board. [0:08:19, 0:08:37]: So before you, as read in the record, we are presenting a test amendment for specialized housing facility. And what this test amendment will do is allow for housing for um those that are homeless or looking for a um [0:08:38, 0:08:55]: that are going through an economic hardship in uh finding housing. And what we designed this test amendment to do is allow for this type of facility in certain zoning districts, such as C two, C three, O I, and L I. [0:08:56, 0:09:16]: So if you turn to the third page, exhibit A, um, that goes into the definition of specialized housing facility, I'm going to read in the record the definition of such facility. So it is a shelter, home, a refuge for those in urgent need or in times of [0:09:16, 0:09:36]: Of emergency. It is designed to provide temporary living accommodations to individuals or families who are experiencing homelessness in general. The facility may provide for overnight safe and secure environment for persons who may be experiencing financial difficulties, domestic, [0:09:36, 0:09:49]: Abuse or other challenges. This does not include substance abuse centers, personal care homes, boarding homes, and group homes. There are different types of housing shelters. [0:09:49, 0:09:53]: So there's a type tier one, tier two, and tier three. [0:09:53, 0:10:04]: So tier one states a shelter providing homelessness services whose primary purpose is to provide temporary shelter for no more than thirty days. [0:10:05, 0:10:25]: Tier two states a shelter providing homelessness services whose primary purpose is to provide temporary shelter for no more than six months. And the last tier three states a shelter providing homelessness services whose primary purpose is to provide temporary shelter for no more than a year. [0:10:24, 0:10:32]: So this language will be placed in the section 5.2 of our UDC. And um as you [0:10:33, 0:10:37]: Listen to me read that into the record. That's how it will read into our code. [0:10:38, 0:10:58]: If you go to letter B that states housing shelter as a permitted use, this will affect sections 2.4.6, 2.4.9, and 2.4.10 of the UDC. So it will be amended to add specialized housing facilities. [0:10:58, 0:11:12]: It's a permitted use under OI, which is official institutional, C2, General Commercial, C three heavy commercial districts, respectfully. And I failed to mention L I. [0:11:13, 0:11:30]: W which is light industrial. Um, the use table 3.1, section 3.1 will also be amended to add specialized housing facility in the list of specialized housing facilities as a special use permit, um, requiring a special use permit. [0:11:31, 0:11:51]: And for those that are not aware what a special use permit, um, that is a zoning request um to have a a special type of use. It requires a public hearing, so they will have to go before uh community zoning meetings as well as planning commission and the [0:11:51, 0:11:56]: last stop will be city council. So city council will have the final vote. [0:11:57, 0:12:17]: Now, if you look at section D, supplemental regulations that will affect section 3.2.17. So that section speaks to nursing homes, assisted living, hospice care facilities. We're planning to modify that section to include [0:12:17, 0:12:28]: special specialized housing facilities in the caption and in the table. And that additional row will be added to the table to require a 50-foot buffer. [0:12:29, 0:12:33]: When when specialized housing facilities are located adjacent to [0:12:34, 0:12:42]: uh rural residential, suburban residential, CCR, MFR, and RMH zoning districts. [0:12:44, 0:12:47]: Number two states the section for [0:12:47, 0:13:07]: 3.2.26 under supplemental use regulations will also be modified, and there will be um supplemental regulations that one will have to follow in order to be a specialized housing facility. And they read one in addition to required setbacks, a minimum. [0:13:07, 0:13:27]: A 50-foot-wide buffer shall be required along all property lines, which abut a residential district or use to provide a visual screen. B The specialized housing facility is not located within one mile of another homeless shelter. C One must meet [0:13:27, 0:13:38]: meet all regulations as identified and ad um adopted by our building code and adopted by the fire code. So they will have to meet those regulations. [0:13:42, 0:13:49]: D um all facility must apply for and receive a business license. [0:13:51, 0:14:11]: No more than 40 beds are um are to be maintained within the shelter. So they cannot have no more than 40 beds. F no alcoholic beverages or controlled substances are stored, served, sold, consumed, or in the possession of any person in the shelter. [0:14:11, 0:14:27]: G, the homeless shelter provides on-site parking and or a drop off space to adequ adequate to meet the needs as adequate to meet the needs of proposed facility, provided, however, that any modifications to the existing parking are [0:14:27, 0:14:33]: or drop off area will not increase the overall square footage of the existing area. [0:14:34, 0:14:35]: H. [0:14:35, 0:14:53]: The agency or organization must be registered through the Georgia Department of Community Affairs in the HUD Continuum of Care Program, Permanent Supportive Housing Program, or related State of Georgia Homelessness Services Program. [0:14:53, 0:15:02]: The facility, I the facility must maintain adequate trash service to prevent the accumulation of waste on the premises. [0:15:02, 0:15:14]: J. An operable telephone is maintained and readily available in the shelter, provided that in the event of an emergency or physical altercation, the city shall be immediately contacted. [0:15:15, 0:15:28]: And the last, which is K, is laudering, camping, sleeping, et cetera, on the sidewalks is prohibited and such shelter shall ensure compliance with the City of Stockbridge ordinance regulations. [0:15:28, 0:15:33]: So that completes my presentation on specialized housing facilities. [0:15:36, 0:15:37]: Thank you, Miss Jackson. [0:15:39, 0:15:42]: Are there questions there from the commission? [0:15:42, 0:15:44]: Yes, I do. A couple of questions, please. [0:15:46, 0:15:56]: So um just out of curiosity, is this being driven by a homeless prop problem in the city and how many potential shelters could be built? [0:15:56, 0:15:57]: Or do we have a number? [0:15:58, 0:16:06]: So there's not a specific number. They have to be at least a mile apart. So depending on that um [0:16:07, 0:16:16]: The distance will pretty much determine um but again they have to come before the board to get uh the approval to operate. [0:16:17, 0:16:37]: Also um there there isn't much available land in those districts, so uh we don't envision there being um more than three or four at the max. Uh and yes, it it is to deal with the problem of housing encampments in the city of Stockbridge. [0:16:37, 0:16:39]: That's w that is what precipitated this ordinance. [0:16:40, 0:16:41]: Well, this text amendment. [0:16:42, 0:16:43]: That's what's behind it. [0:16:44, 0:16:45]: Thank you. [0:16:48, 0:17:00]: Any of the questions? Uh may I speak, Mr. Chairman? Go right ahead, sir. Uh I notice uh you didn't mention anything about weapons. Uh no restriction as far as weapons are concerned in here. [0:17:01, 0:17:05]: Uh you did everything uh as far as laundering and [0:17:05, 0:17:25]: And different things, camping, but there was nothing mentioned about weapons. We have a issue with weapons right now. This should have been included in the in the in the document, but we will add it to make sure that it that it is in the final version. This is just the draft. So any recommendations that um that the planning commission makes tonight, we will we will include it in [0:17:25, 0:17:29]: in the final draft. So if you recommend we add that, we will add it. [0:17:30, 0:17:31]: Correct. Thank you. [0:17:34, 0:17:38]: Mr Anderson, does this uh text amendment require a public hearing? [0:17:39, 0:17:55]: Yes, it will be subjected to the public hearing process because it it will require a special use permit. They will have to come before the planning commission and then go before city council. My question is w with respect to tonight, do we need to open the floor for a public hearing? Yes, sir. Okay. Thank you. [0:17:58, 0:18:00]: This is David Planchon. I have a couple of questions. [0:18:02, 0:18:08]: Um, is this going to be an actual hard facility or are you just gonna open up ground to allow tent cities? [0:18:10, 0:18:27]: Um tomorrow, I'm sorry. No, we won't be opening up ten cities ten cities. This will have to be a facility. And and do you anticipate this is going to draw people from outside the city of Stockbridge area, or are you gonna keep it to this homeless we have here in Stockbridge now? [0:18:27, 0:18:47]: I mean we don't know exactly where the homeless I mean, you know p homeless people can travel to Stockbridge. Move well move to Stockbridge. So I'm not sure if we will limit or restrict restrict it to citizens of Stockbridge. Um primarily um homel the homeless community, they travel from communities [0:18:47, 0:18:53]: to the community. So I don't know if we'll have those type of limitations, but hopefully um [0:18:54, 0:18:55]: And our intent [0:18:55, 0:19:05]: is for it to be for uh residents of the city of Stockbridge, but we can't um dictate whether or not a homeless person will will um be from the city of Stockbridge. [0:19:06, 0:19:10]: As long as it's not used as an attractant to bring in more homeless than we already have. [0:19:11, 0:19:15]: No, that's not the intent behind the work. Yeah, but it it's gonna happen. [0:19:18, 0:19:25]: We're just trying we we're just trying to deal with the um the current homeless problem we have in the city right now and um also to help [0:19:26, 0:19:29]: The veterans and other groups affected by homelessness. [0:19:33, 0:19:35]: Other any more questions, please. [0:19:37, 0:19:38]: Thank you, Ms. Jackson. [0:19:41, 0:19:48]: As you heard, we'll require public hearing, so I wanna go over a few housekeeping chores. [0:19:50, 0:19:56]: With regard to the public hearing, number one, please mute all cell phones and electronic devices. [0:19:57, 0:20:08]: If anyone wishes to speak tonight on a public hearing item, please fill out a form available on the table at the right, at the hand hand it to the city clerk before approaching the podium. [0:20:10, 0:20:19]: After each case is called the council will hear from the city staff, followed by the applicant or their representatives regarding the proposed plans. [0:20:21, 0:20:25]: The council will be free to ask questions any time before the vote. [0:20:27, 0:20:35]: Following the applicant, anyone who wishes to speak in favor or opposed to the case will have the opportun opportunity to do so. [0:20:36, 0:20:38]: Each side will be allotted ten minutes total. [0:20:39, 0:20:45]: Additional time may be extended at the discretion of council or the commission. [0:20:46, 0:20:53]: Please keep comments and presentations professional, referring only to the facts that are pertinent to the case. [0:20:56, 0:21:01]: We will not allow comments or personal attacks toward any individual or group. [0:21:02, 0:21:10]: Please refrain from any applause or comments during the audience from the audience during the public hearing. [0:21:11, 0:21:18]: After the presiding officer recognizes the speaker, he or she shall direct all comments to the presiding officer. [0:21:18, 0:21:20]: And never to the members of the commission. [0:21:21, 0:21:22]: Stay off [0:21:22, 0:21:24]: All the audience [0:21:24, 0:21:29]: All comments will be made from the podium where you will be required to state your name. [0:21:29, 0:21:31]: An address for the record. [0:21:32, 0:21:36]: Please note please note that these hearings are not a debate. [0:21:38, 0:21:47]: Failure to comply would cause you to be removed from the chamber and the building by law enforcement if you if you de deviate from these proceedings. [0:21:49, 0:21:53]: Other than the applicant, no person may speak more than once. [0:21:54, 0:21:57]: The applicant may reserve part of his or her speaking time. [0:21:58, 0:21:58]: As a rebuttal. [0:21:59, 0:22:07]: And may speak next and last, may use the entire ten minutes allowed for the pro side of the application. [0:22:08, 0:22:13]: If questions are raised, the counselor may ask the applicant to address questions or concern. [0:22:15, 0:22:22]: The presiding officer will call for a motion and second to the motion and have any necessary discussions. [0:22:22, 0:22:26]: If the matter is not tabled, the presiding officer will call for a vote. [0:22:27, 0:22:31]: To recommend approval or denial of of the request. [0:22:34, 0:22:34]: Thank you. [0:22:36, 0:22:46]: Mr Chair, if we could, um before we get to the next case, can we read them into the record together, discuss it together, but vote separately? [0:22:47, 0:22:48]: We can do that. [0:22:49, 0:22:57]: But first you you need to open up for those in a approved or those not in approved. Not in appr not in favor. [0:23:00, 0:23:08]: Okay. With respect to the text amendment case T X twenty twenty four dash zero four for housing shelters. [0:23:10, 0:23:18]: I'd like to know if there's anyone in the building who opposes this text amendment. [0:23:20, 0:23:22]: And wishes to speak. [0:23:26, 0:23:29]: If you wish to speak, please line up in that owl. [0:23:30, 0:23:33]: And proceed to the podium. [0:23:34, 0:23:36]: Give your name and address. [0:23:40, 0:23:54]: My name's Connie Snow, 426, Chase, Mary and Way, McDonough, Georgia, 30253. My question more likely is uh what areas of town in Stockbridge would this be located? [0:23:54, 0:24:00]: So for example, I know we're saying it's gonna be in areas that were designated C two, C three, is that correct? [0:24:03, 0:24:07]: Yeah, G that's correct. That is correct. Yes. [0:24:07, 0:24:27]: So I'm pretty sure, like I if I'm not mistaken, and maybe you guys might need to look back in their records, but in recent annexations and rezonings for Patrick Henry, I do believe some of those developments were classified as C2, maybe possibly C three. Would any of those facilities be close or [0:24:27, 0:24:33]: be placed on the Patrick Henry Parkway area or Holloway or any cl anywhere close to the schools. [0:24:34, 0:24:47]: I can answer that. Um no, the intent is to ins to exclude exclude those type of facilities from the parkway mixed use overlay district and that area is is is within the parkway mixed use overlay district. [0:24:48, 0:24:49]: What area? [0:24:49, 0:24:50]: Patrick Henry Parkway. [0:24:51, 0:25:08]: So we're we're saying those that this won't wouldn't be placed on Patrick Henry, correct? They will be excluded from the PMU and and park Patrick Henry Parkway is is inside the PMU, the Parkway mixed use overlay district. They will not be allowed in the overlay district. Okay. So do we know where they would exactly be placed? [0:25:09, 0:25:29]: I mean not exactly, but uh uh the PMU uh covers about sixty to seven between sixty and seventy percent of of the entire city. It mostly covers areas where there are large arterials or collector streets, uh like um Rock Quarry, um how [0:25:28, 0:25:35]: 138, Patrick Henry Parkway, East Atlanta Road, uh, Eagles Landing Parkway. So they will be excluded from areas like that. [0:25:37, 0:25:45]: But am I right in saying that this is going to be held for a public hearing on June tenth, correct? Yes, ma'am, before city council. [0:25:45, 0:25:53]: So shouldn't those areas be defined before that even makes it to a public hearing so the community has a right to offer their input? [0:25:53, 0:26:09]: Yes, ma'am. I mean it it's defined now if they look at the um the land use map or the um or the city or the map of the city or the zoning map. So I'm asking the f definition, what street areas are we looking at this impact for? [0:26:11, 0:26:13]: Is it Hudson Bridge? Is it? [0:26:13, 0:26:15]: Ellen Wood is it? [0:26:15, 0:26:33]: Jodaco, is it Pate's Creek? I mean that's what the question we're asking. So then what areas? It would be areas mostly off major art that are not included in on major arterials or collector streets. [0:26:34, 0:26:37]: Would it be possible to get an actual [0:26:37, 0:26:46]: 'Cause I mean, on the site, there's no map or anything that's outlaying anything that's being heard today. There's no applications, nothing that's really being [0:26:47, 0:27:07]: Entered of substance where the community can actually look at what's going on. So that's the point I'm trying to make. Uh we have my point is, let me finish, is if we could please get a full detailed report of where we can anticipate where this housing will be or what we're proposing, so that the citizens of the community. [0:27:07, 0:27:25]: can be aware of what's gonna happen to them. That's all I'm asking. Well your point is is is well taken ma'am. However uh those areas uh are designated um well basically what we have done we've ex we've we've uh identified the areas areas where they will be excluded. [0:27:26, 0:27:32]: So So when do we identify the areas where it's gonna be included? [0:27:32, 0:27:39]: Well, I would hope that you guys would have that available way before the hearing so that we have time to review it. [0:27:40, 0:27:41]: Oh [0:27:43, 0:27:56]: Uh Mr Mr Chair, may I speak? Yes, sir. Um I'm I'm listening to the young lady and everything she's saying is correct. And what's happening is she's basically saying [0:27:56, 0:28:02]: that we're making decisions and move without really presenting the whole package to the community. [0:28:02, 0:28:22]: Uh this is what I'm getting from her. That's not the case. Um Well what is the case, but I'm listening to this young lady speak and you're not exactly telling everything she needs to know. We we're identifying the areas where they will not be allowed. And that's all we really have to do. I mean if if they're they're excluded from certain dish zoning. [0:28:22, 0:28:31]: zoning districts and the overlay district, then anywhere else in the city that has the specific zoning district that is mentioned, they can go there. [0:28:32, 0:28:52]: I I understand that th but I I also understand the question that she's trying to ask. She's basically saying, Hey, you're putting information out there and they don't think that they're getting all the information they need to understand what we're doing about this particular situation. [0:28:52, 0:28:55]: being very transparent and um the information is available. [0:28:56, 0:28:59]: Um you just have to look at a zoning map. [0:29:01, 0:29:21]: When Patrick Henry Parkway was annexed into the city, it was annexed with the anticipation of being a commercial slash high density housing zone because it's uh adjacent to the interstate, which is required for all high density housing, plus commercial, you know what's going on down at Jodigo Road and it's it's [0:29:21, 0:29:41]: Amazing for the county. I can't imagine this is my personal opinion. I can't imagine throwing in the middle of all of that this kind of facility. And the parkway mixed use overlay district will exclude their use. Yep. I know what it is now, but it there aren't many areas where they [0:29:41, 0:30:01]: They can go in the city, but we will try to do that. This this is a public hearing. We have people w waiting to speak. We can discuss those issues after the public has weighed in. Any other questions that need to be clarified, we'll be happy to do that at that time. [0:30:01, 0:30:06]: Ma'am, would you please state your name and your g give us your address and proceed? [0:30:06, 0:30:26]: Tasha Kempel, 410, Chase Marion Way, McDonough, Georgia, 30253. Um, this is the first I've heard about this meeting tonight, um, along with some other items that are on the agenda. Um, I feel like City of Stockbridge, the councilman, and slash lady, um, lady. [0:30:26, 0:30:40]: They don't address most of the issues to the public, the citizens that live here in the city of Stockbridge. So I feel like a lot of these items are getting passed without the you know proper posting on the [0:30:40, 0:31:00]: pages where people can read or something like that if they want to attend. So I would like to state um as far as the homelessness, um you've got homeless people that are criminals that you're gonna be housing. Um that's really dangerous. Um ex like what if there's someone [0:31:00, 0:31:17]: That's homeless, that doesn't have a record, their life might be in danger. So there's one point. Then you got the other point. What about the security about the surrounding people? Like, I don't know. So, anyways, I don't agree with any of this and that's all I gotta say. Thank you. [0:31:21, 0:31:22]: Next, please. [0:31:27, 0:31:43]: Uh good afternoon. Uh thank you everyone on the council. My name is Jocelyn Williams. I live at one ninety Banks Drive, uh Stockbridge, Georgia, three oh two, eight one. I'm in uh opposition to the uh homeless buildings being built. I think they s mentioned we could have up to four. [0:31:44, 0:32:04]: Uh if I'm correct when they were discussing it, the maximum could be four. Was that the number that I heard? That was just an um I was just d guessing, really. I'm not sure uh exactly how many it will be, but we always can place a limit in the uh in the text amendment based on the comments we get tonight. [0:32:04, 0:32:15]: This is a draft that we're presenting tonight and we'll take the comments that we received tonight and we'll we will rework the text amendment to include a specific limit if that's what the public will want. [0:32:15, 0:32:35]: Okay. I also want to uh thank you for this opportunity for us to speak. Um piggybacking on if if we could get uh tonight where we could go and get information. I'm new I was just annexed into um um Stockbridge. I'm excited about it. I came from Henry County and it's done differently. So whatever procedures and guidelines that [0:32:35, 0:32:55]: Stockbridge has for us to find this information. I'd be so grateful if uh so I can make an informed decision. But my rec record is showing that I'm in opposition but would like to move forward where we could get exact information. I don't I'm elderly, I don't know how to read the zoning maps. So I want to thank you, Mr. Anderson, if somebody could break it down so that I could have [0:32:55, 0:33:07]: Yes, ma'am. Okay, I appreciate you. And you can speak to one of our staff members off the record and they'll they'll give you additional. Okay, I thank you. Thank you, Counselman. Thank you. Next, please. [0:33:13, 0:33:29]: Uh good afternoon, good evening, gentlemen and ladies. Um my name is Christina Lovett and um I just recently purchased my home in Stockbridge. I live at uh 180 Oakwood Circle in Stockbridge, Georgia, 30281. [0:33:30, 0:33:32]: And I wanna apologize for coming in a little late. [0:33:32, 0:33:52]: But I I kind of came in on the tail end of the um comments that were being made in the discussion for homelessness. Um I wanna say that um I don't know exactly what uh areas you're talking about, but I got a letter in the mail at this [0:33:52, 0:34:12]: This address stating that there was going to be a hearing today about re um zoning, possibly rezoning, right around the street that I live. And I wasn't sure exactly what that meant, but I do want to say that I am in favor with the limited [0:34:12, 0:34:32]: information I have of for trying to help the homeless population as long as like the one lady commented, as long as it's safe for the public. But we do need to do something for homelessness. I'm the CEO of [0:34:32, 0:34:36]: Um somewhere to go. [0:34:38, 0:34:53]: somewhere to go. It's a a non profit uh to help people who are homeless or underhoused, um, generally for no fault of their own. I'm also a disabled veteran and so um it's very important to me [0:34:53, 0:35:13]: uh that somebody does something about the homelessness uh in our communities across the board. Um I lived in Clayton County and then I per purchased a home here in Henry County. So my my question would be [0:35:13, 0:35:15]: The um [0:35:16, 0:35:23]: What the lady uh this woman here had said earlier, it would be very important for us to have. [0:35:24, 0:35:24]: Um [0:35:25, 0:35:35]: knowledge of exactly where uh the homeless shelters were going to be. And can I ask how many homeless shelters? [0:35:35, 0:35:50]: We're not as Mr. Dunwell's gonna answer that or you want me to go right ahead, sir. We can't uh say for sure, but we will add to the text amendment, we will probably limit it to two or three until the city population grows. We'll we'll put in a statement to that effect. [0:35:50, 0:35:57]: Yes, sir. What we're presenting tonight is basically a draft. So we want to get the s the the community's input on it. It's not a final draft. [0:35:57, 0:36:02]: So after this meeting we will go back and work on it based on the comments and feedback we received tonight. [0:36:03, 0:36:05]: Thank you. And um [0:36:06, 0:36:17]: Is is that going to be in the part of the area that you were saying for the maps, is that going to be around Oakwood Manor, um, close to the Walmart here? [0:36:18, 0:36:26]: Ma'am, uh we can't we can't say for sure, but uh we know the areas that they will be excluded from. So uh um exactly where [0:36:27, 0:36:31]: They will be they would have to go to those specific zoning [0:36:31, 0:36:35]: uh districts that have been mentioned. They won't be in residential neighborhoods. So [0:36:35, 0:36:37]: We realized that it could um [0:36:38, 0:36:56]: possibly have a negative impact on residential uh zoning districts. So it it will not be allowed in residential districts. So we're trying to reduce the impact on our citizens. But however, um there is a big problem in the city that we want to address as far as housing encampments. So we feel like this is the most fair way to do it. [0:36:57, 0:37:17]: Okay, I would I would love to be able to work with um this program, you know, to be of assistance. My uh um nonprofit is hoping to try and house people with the home voucher programs uh to put them into hotel areas and things like that. So I would love to be able [0:37:17, 0:37:21]: able to be a a part of it. I'm I'm finished, but thank you all. Thank you. [0:37:23, 0:37:43]: Miss No, because you're an exceptional lady, we're gonna make an exception and allow you to speak one more time. I just have one more question. I just have one more question. Is this gonna impact any of the TAD districts, specifically those in the downtown district where there are elderly people where the city's already approved a couple of property attacks creases? [0:37:43, 0:37:55]: I just want to make sure we're not gonna hit those elderly people anymore with any other tax increases that we've already done. [0:37:55, 0:38:05]: Ma'am, it will be ex like I mentioned earlier, it w the overlay districts will be excluded. Okay, cool. The downtown overlay district, they will not be allowed in that area. [0:38:05, 0:38:11]: Will you let us know when you know what's gonna be included? How about Mr. Chairman, I have a question. [0:38:12, 0:38:23]: Like all ordinances and and r request to change what we have, where did this request come from? Who requested this ordinance change? [0:38:25, 0:38:35]: Uh Mr. Plans and uh it it was just uh a request so we can try to d deal with the um the housing encampments and and homelessness problem in the city. [0:38:36, 0:38:43]: That's that's what's spuriating. Just out of the blue or does somebody some body get together and it's the ongoing problem. The city wishes to address it. [0:38:44, 0:39:04]: So no one specifically recommended it, but there's a need for it within the city. Well, there's a need worldwide for it, but Stockbridge is kind of a small creature on the That's that's true, but we have a significant uh homeless population and okay I'll just address that issue uh before it gets out. [0:39:04, 0:39:12]: Okay. I was just curious if somebody actually requested it. Can we hear from the next individual, please? [0:39:15, 0:39:21]: Hi, I'm Cyrinthia Evans at one forty six Could you speak into the microphone please became I'm Cyrinthia Evans? [0:39:23, 0:39:24]: Go right ahead. [0:39:24, 0:39:35]: 146 St. Margaret Circle, Stockbridge, Georgia, in reference to your proposal. And I am a veteran. [0:39:35, 0:39:40]: I take exception to throwing it out as a [0:39:41, 0:39:43]: that title veteran. [0:39:43, 0:39:47]: To encourage this development. [0:39:47, 0:39:53]: Do you have any figures on the number of homeless people that are in camping in Stockbridge? [0:39:54, 0:39:55]: Not an exact figure, man. [0:39:56, 0:39:58]: Okay. You say that you have [0:39:58, 0:40:01]: Excluded certain places. [0:40:03, 0:40:07]: from being possible sites for the zoning district. [0:40:08, 0:40:17]: Okay, so for and in the same sense I feel that you've also taken a look at places that would accept this facility. [0:40:18, 0:40:21]: So at what point do you think that you'll reach that? [0:40:22, 0:40:24]: Say accept, what do you mean? [0:40:24, 0:40:31]: As far as the placement of this facility, you're saying that you have ruled out certain areas, right? [0:40:33, 0:40:35]: Based on the compatibility. [0:40:36, 0:40:37]: Based on what? [0:40:37, 0:40:39]: compatibility. [0:40:39, 0:40:42]: Compatibility for the facility? [0:40:43, 0:40:44]: The land use. [0:40:44, 0:40:46]: Oh, for the land use. Okay. [0:40:47, 0:41:02]: All right, I'll make it. I oppose until I have more information about what and where this will go. I like where I live and I do not want to see more changes. There are different things that are around my [0:41:03, 0:41:08]: home that I am concerned about. So for add anything else, no. [0:41:09, 0:41:10]: Thank you. [0:41:12, 0:41:13]: Thank you very much. [0:41:15, 0:41:20]: Is there anyone present who wishes to speak in favor of this text amendment? [0:41:27, 0:41:34]: Hearing none, the public hearing aspect is now closed. Thank you very much for your comments. [0:41:37, 0:41:42]: Are there any more questions or comments from staff? I'm sorry, from the commission. [0:41:43, 0:41:50]: One question regarding you say this is a draft. So will we have the opportunity as a commission to see a final [0:41:50, 0:42:06]: Yes, you'll you'll be able to see a final, yes. And um and the purpose of this meeting tonight is basically to get input from the Planning Commission and from residents. So that will give us a chance to improve the document prior to us sending it to city council. So this will come back to this commission. [0:42:07, 0:42:27]: No, it won't come back to this commission, no sir. So it will go final package will go straight to the city council for public debate. Unless you vote to uh defer and and then if you vote to defer, um then the city council will have to will have a choice to make whether or not they agree with your um recommendation, but they still will have the choice to make a mic. [0:42:27, 0:42:31]: us to proceed with the with the legislation if they d if they desire. [0:42:33, 0:42:36]: But we will take in all comments that we have received tonight. [0:42:37, 0:42:39]: and uh incorporate them into the document. [0:42:41, 0:42:55]: Okay, I just wanna make sure that this is not go to the city council next month and is voted. I just wanna make sure this does not go to the city council next month and is voted on as a final package and I think there's still a lot of questions here on this commission. [0:42:56, 0:43:01]: Yes, yes, sir, I understand that, but we will uh incorporate all the comments and feedback. [0:43:02, 0:43:06]: That's applicable that we've heard tonight into the draft. [0:43:07, 0:43:08]: Thank you. [0:43:09, 0:43:11]: Mr. Chairman, may I speak? [0:43:12, 0:43:12]: Um [0:43:14, 0:43:26]: I I kinda understand the dilemma here and and it seems to be that we are lacking information in terms of what the city council wants to do. [0:43:26, 0:43:28]: But I will say this, uh [0:43:30, 0:43:31]: This planning zoning. [0:43:32, 0:43:36]: does not make the last decision. We we can say yes [0:43:37, 0:43:43]: And the city council I mean we can say no and the city council can say yes at the end of the day. So you need to understand that. [0:43:43, 0:43:48]: That we don't have the last say so no matter what comes up. [0:43:49, 0:44:09]: At this planning zoning meeting. So just keep that in mind when you come up here and address issues with us. The city council has the final say-so, no matter what decision we make. And for all those veterans, I'm also a veteran. I'm one of your Vietnam veterans. So you do have some. [0:44:08, 0:44:12]: Thank you. [0:44:15, 0:44:35]: Any more comments, please. Mr. Uh Chairman, I would just like to say those of you who oppose, I understand uh the seriousness of your concerns, and uh it is my heart desire that uh information would be given to you um concerning the defined areas because I can definitely [0:44:35, 0:44:38]: and at least uh understand cut circles. [0:44:44, 0:44:46]: The areas have been defined, sir. [0:44:47, 0:44:52]: The the areas have been defined. We we w we mentioned four specific districts. [0:44:53, 0:44:58]: So just you just have to look at the zoning map and look for those zoning districts. [0:45:03, 0:45:23]: I think it may be important, uh, Madam Secretary, if you would read back to us the amendments that have been articulated that Mr. Anderson has informed us would be [0:45:22, 0:45:27]: add it to this m text amendment for the record before we vote. [0:45:30, 0:45:31]: What did you capture? [0:45:31, 0:45:51]: Sure. One of the items I captured is to include weapons as a prohibited use or um one of the prohibited uses. Um the other is to define more of where in the city these facilities will be located. [0:45:51, 0:46:11]: And um I understand that there's a question on do we know the population of our homelessness in the city of Stockbridge? So we would definitely um look into or research that information and provide it at our next meeting. Um [0:46:11, 0:46:20]: take into consideration to place a limitation based on the population of the city of Stockbridge on the number of those type of facilities that can be in the city. [0:46:22, 0:46:23]: Anything else? [0:46:24, 0:46:26]: That's the gist of what I have. [0:46:28, 0:46:31]: Okay. Thank you very much. Thank you. [0:46:33, 0:46:53]: Mr. Chairman, I just want to make a comment. You said the areas are defined. Yes, sir. The areas are defined. But she used the word they're where. I guess that's what I'm saying about. I'm not sure which her intent was, but we listed four specific districts in which they are allowed. Zoning districts in which they are allowed. [0:46:53, 0:47:00]: Allowed and they cannot go in and it cannot be included within the Parkway Mixed Use Overlay District and the Downtown Overlay District. [0:47:01, 0:47:02]: So it's really [0:47:02, 0:47:07]: Just four areas that are excluded of those two overlay districts. That's not much land. [0:47:11, 0:47:27]: And we we will w when we go back into the office tomorrow, we will update the the document to um we will come up with a exact number that we feel would be appropriate before we move forward to the city council. Uh I'm thinking maybe two or three at the max. [0:47:31, 0:47:32]: Thank you. [0:47:32, 0:47:43]: Uh I need a motion please uh with respect to text amendment case uh for housing shelters incorporating the uh [0:47:45, 0:47:52]: Amendments that Ms. Jackson just articulated. Could I get a motion from the commission, please? [0:48:03, 0:48:09]: Let me be more specific him, but can I get a motion to approve from the commission? [0:48:12, 0:48:15]: Can I get a motion to deny from the commission? [0:48:16, 0:48:25]: Mr. Chairman Dave Planchon, I'd like to make a motion to deny this uh proposed change to our city ordinance. [0:48:26, 0:48:42]: Is there a second? I second it, Harold. It's been moved by Mr. Planchon and seconded by Mr. Thibodeau that we deny the text amendment case TX twenty four twenty twenty four-zero four for housing shelters. All in favor, let it be known by the sound of I. [0:48:43, 0:48:44]: Okay. [0:48:45, 0:48:45]: In your polls. [0:48:48, 0:48:54]: The eyes have it. The text amendment case is denied. Thank you, Ms. Jackson. [0:48:55, 0:48:56]: You're welcome. [0:48:58, 0:49:06]: Next case, comprehensive plan amendment case p twenty twenty-four-zero one, council district five. [0:49:07, 0:49:18]: The City of Stockbridge Planning Commission will hold a public hearing on Thursday, May 16th, which is today at 630. The City Council, Mayor and the City of Stockbridge. [0:49:19, 0:49:39]: Located at 4640 North Henry Boulevard in Stopridge, Georgia, to consider a comprehensive plan amendment request to change the future land use designation of property on the north side of Hudson Bridge Drive comprising Parcel 032-0. [0:49:39, 0:49:51]: Sero one zero two six thousand from medium density mixed use to medium density residential to allow for the construction of a town home development. [0:49:52, 0:49:56]: The applicant is Lenar, Georgia, LLC. [0:49:57, 0:49:59]: Agent is battle law PC. [0:50:00, 0:50:10]: Property is located in land lot twenty-one of district six and it contains twenty p point three point three point three six seven acres more or less. [0:50:13, 0:50:15]: To present about there, please. Go ahead. [0:50:16, 0:50:23]: If I can, Mr. Chair, um, can we also read the rezoning component to this comprehensive plan? [0:50:23, 0:50:27]: Resulting case RZ dash twenty twenty four dash zero one. [0:50:29, 0:50:39]: Council District 5, the city of Stockbridge Planning Commission will hold a public meeting on Thursday, May 16, 2024 at 6:30 p.m. [0:50:40, 0:50:49]: And the city of Stockbridge mayor and city council will hold a public hearing on Monday, june tenth, twenty twenty four at six PM. [0:50:50, 0:51:10]: in the Stockbridge City Hall located at forty six forty North Henry Boulevard in Stockbridge, Georgia, to consider a request to rezone property on the north side of Hudson Bridge Drive comprising parcel zero zero thirty-two-one zero two six thousand. [0:51:10, 0:51:10]: Yeah. [0:51:11, 0:51:20]: from the C two General Commercial Zoning District to the multif MFR multifamily residential zoning district. [0:51:21, 0:51:25]: to allow for the construction of a town home development. [0:51:26, 0:51:27]: The property [0:51:28, 0:51:33]: also lies within the PMU, the Parkway Mixed Use Overlay District. [0:51:34, 0:51:48]: Applicant is Lenard Georgia LLC agent. It's Battle of Law PC. The property is located in land 21 of District 6, and it contains 20.367 acres, more or less. [0:51:49, 0:51:50]: Two presenter was air. [0:51:51, 0:52:11]: Thank you, Mr. Chair. The subject property before us tonight, um, the applicant is proposing a development of a townhome community that will consist of 140 fee simple units at the parcel number that was read into the record. The entire acreage of this parcel is [0:52:11, 0:52:25]: 20.367 acres of district six, landlock 21. And as mentioned, the applicant is Lenar Georgia, Cara of Better Law PC. So the property is currently zoned C2. [0:52:27, 0:52:41]: And what the applicant is seeking is to rezone that property to MFR, which is multifamily residential, and also to change the land use to misuse. [0:52:41, 0:52:50]: Medium density misuse uh to allow, I'm sorry, medium density residential uh to allow for this townhome development. [0:52:51, 0:53:11]: Now this has been before you a few times, and I'm just going to go over the background for those that are not aware of this um zoning request. So previously it came to you um in multiple facets of the zoning request. [0:53:11, 0:53:31]: This was originally a part of the Walmart master plan development plan and this property also went through a DRI process. The Sudra property um was a part of the again Walmart Supercenter as a misuse development for a total of 70.16 acres. And [0:53:31, 0:53:51]: And what happened was at that time, that entire property was annexed into the city of Stockbridge. When that property was annexed into the city, it was zone C2. And it was then split. So you had track one and track two. What we're currently speaking of, this side is on track one. [0:53:51, 0:53:55]: one and the Walmart Super Center is on track two. [0:53:56, 0:54:16]: Now the original track two um became a standalone parcel for future development. Um there was a covenant on the property that basically restricted retail uses. That covenant has now expired, so therefore this applicant now has the autonomy to come before you and ask for. [0:54:16, 0:54:18]: for this type of rezoning. [0:54:19, 0:54:39]: Um as I mentioned before there was a DRI um plan that was um put in place to um look at the traffic, look at uh environmental concerns, etc. Um after the review the site shall be used a [0:54:39, 0:54:59]: Shall be misused and contain a minimum of 200 residential units and a mass of 343,500 square feet. Um that DRI conditions have now expired. So it has been 10 years since that DRI. So we're looking at, let's go to the zone. [0:54:59, 0:55:12]: activity that was first first came to you in 2019. And that was RZ 2019-04. And at that time the applicant requested a 118 home [0:55:12, 0:55:32]: townhome development on 18.23 acres. It was eventually approved by both Planning Commission and City Council on October 14, 2019. However, the applicant at that time redrew the application and there was no further action. [0:55:32, 0:55:33]: Yeah. [0:55:36, 0:55:56]: In 2020, an another application came before you, also a rezoning. And in this case, the applicant sought a rezoning of 147 townhome development. Now the Planning Commission did hear the case on June 25th, 2020. [0:55:56, 0:55:56]: [3357.0, 3365.1]: Uh both the staff and planning commission recommended approval with conditions. It did go to city council. City council denied it. [0:56:07, 0:56:23]: In 2022, another applicant, which is battle law and uh representing Carter acquisitions came before us and the change or the zoning request changed somewhat. [0:56:24, 0:56:32]: They requested to rezone the property from C two to MFR to allow for the development of a townhome community. [0:56:32, 0:56:48]: Um however they wanted 330 units. The proposed development was over the allowable density of sixteen units per the high density residential future land use designation. Uh therefore [0:56:48, 0:56:50]: Um after [0:56:50, 0:57:08]: talks with the applicant, the applicant redrew their application along with their comprehensive plan amendment, which was CP-2022-07. So here we are today in 2024. Again, speaking of trap one is where they want to build this development. [0:57:08, 0:57:28]: Um, although this development will consist of 140 townhomes, which is far less than um what was previously brought to you, um they will need a comprehensive plan, comprehensive plan change to proceed with this development. Now before you um you have the parcel, it is planned. [0:57:28, 0:57:33]: pointing at the subject property where they're tending to build the townhomes. [0:57:35, 0:57:36]: This [0:57:37, 0:57:57]: shows the surrounding land use designation. So you have to the north St. Ives apartments. Um there's a subdivision. The land use for those are high density residential. To the south you have commercial uses on Hudson Bridge as well as JJ Liquor and [0:57:57, 0:58:17]: In Western Union, that is deemed as high density mixed use, high density residential. To the east, you have a shopping center that is deemed medium density mixed use. And to the west, you have Oakwood Village Subdivision as well as Oakwood Mainor Subdivision. [0:58:17, 0:58:24]: Vision. Again, those have a Henry County future land use of medium density residential. [0:58:25, 0:58:27]: Um we both do have a [0:58:28, 0:58:30]: A land use of medium density residential. [0:58:32, 0:58:51]: Now, here is just a breakdown of the subdivisions, the number of units that are in those subdivisions. Um I won't read those into the record as you can see. Um so let's get into the project itself. So as I mentioned before, um the future land use change here will allow [0:58:51, 0:59:11]: the developer to be able to construct townhomes on this property after if the rezoning is approved from multifamily residential to be able to do this. Now if you look at the consistency with the comprehensive plan as found [0:59:11, 0:59:31]: On pages 36, 38, and 44, what they're proposing does align with the goals of our comprehensive plan. And those goals are before you to provide a mixture of housing for to attract young professionals, to maintain a family-friendly environment, and a sense of [0:59:31, 0:59:34]: [3575.5, 3592.3]: So with staff analysis, we have um looked at the land use designation as well as the rezoning, and we do feel that the surrounding properties and the f surrounding land use designations does fit in what what is being requested. [0:59:52, 0:59:54]: Um staff has [0:59:54, 0:59:57]: recommended approval. [0:59:57, 1:00:01]: And that concludes our presentation before you tonight. [1:00:03, 1:00:04]: Thank you, Ms. Jackson. [1:00:07, 1:00:11]: Are there any questions or comments from the commission, please? [1:00:12, 1:00:14]: Uh Mr. Chairman. [1:00:14, 1:00:34]: Mr. Mitten had raised the info. Yes, ma'am. So um that corridor between the quick trip and JJ Lickers is pretty much controlled chaos. So is I see that the entrance into the complex is basically going to use that. Is there any has there [1:00:34, 1:00:54]: There been any traffic study, anything done? Great question. We did ask the applicant for traffic study. We did not receive a reply. And if I can take this moment to mention that the front edge of the property, the setback, the front setback is not in compliance with the MF. [1:00:54, 1:01:07]: our zoning district. So the applicant will need a variance um to move forward. So um to answer your question, no, we have not received a traffic study. [1:01:08, 1:01:08]: Thank you. [1:01:10, 1:01:11]: Mr. Turbado, please. [1:01:12, 1:01:22]: I think we would need that traffic study because I I think it already has been done before. Now you said that this has come be before us three times, right? [1:01:22, 1:01:24]: Correct. [1:01:24, 1:01:29]: I I remember this property and uh we had issues with homeliness. [1:01:30, 1:01:41]: people over there and incidents in that area. Uh we also made a lot of recommendations that that area uh would be uh gated. [1:01:41, 1:01:49]: when that time came that we did other things over there, uh there was a lot of recommendations made for this property so that way [1:01:49, 1:01:51]: We wouldn't have issues. [1:01:52, 1:01:56]: Um from my understanding, if you made it commercial [1:01:57, 1:02:11]: it would actually be more traffic. If you made it uh multifamily use, it'll be less traffic from my understanding. Of the years of looking at this property, go back and forth to people that wanna develop it. [1:02:14, 1:02:15]: Anyone else? [1:02:21, 1:02:22]: Thank you, Ms. Jackson. [1:02:26, 1:02:28]: As stated earlier, this is a [1:02:29, 1:02:31]: Public hearing item. [1:02:33, 1:02:40]: We will now open the floor for public hearing. If there is anyone present tonight, [1:02:41, 1:02:43]: Who is in favor of this? [1:02:45, 1:02:49]: Comprehensive plan and rezoning case. [1:02:53, 1:02:55]: You may come to the podium and speak. [1:02:57, 1:03:00]: Hearing none, a seeing none, oh [1:03:01, 1:03:05]: I'm opening it up now for anyone that's opposed to it. [1:03:06, 1:03:08]: Could you please light up in this owl? [1:03:13, 1:03:18]: Is the applicant the applicant needs to speak? Is the applic is the applicant present? [1:03:19, 1:03:21]: I'm sorry, just a moment. [1:03:22, 1:03:23]: Is the applicant present? [1:03:25, 1:03:26]: Apparently not, sir. [1:03:31, 1:03:32]: Okay, you may proceed now. [1:03:37, 1:03:42]: Good evening. Um my name is Barber Floshman. I live at ten twenty six Brandon Road, McDonough, Georgia. [1:03:43, 1:03:45]: I am in unincorporated Henry County and [1:03:46, 1:03:48]: And I'm a landowner and a lot of the stuff [1:03:48, 1:03:51]: Affects me and doesn't affect me. [1:03:51, 1:04:04]: But um I my one question is why do we have a planning and zoning commission if everything y'all say or do gets overridden? I don't know if the city council takes in de into consideration any of your comments or not. [1:04:04, 1:04:05]: But it just [1:04:06, 1:04:07]: It seems like a waste of time. [1:04:08, 1:04:17]: But also we're not supposed to comp complain about traffic. Have y'all dri ridden down Eagle Sandy Parkway lately? And it's like dodged the hole. [1:04:17, 1:04:22]: I mean literally dodge the hole and you're talking about more building. [1:04:24, 1:04:26]: What what about the roads and what about the traffic? [1:04:26, 1:04:29]: My husband and I went to a closing in Locust Grove about [1:04:30, 1:04:31]: Mm, three o'clock. [1:04:31, 1:04:35]: And we were back on the road, where I was gonna come up to Eagle Standing Parkway and get off and get some gas. [1:04:36, 1:04:37]: And um [1:04:38, 1:04:40]: It took me an hour and a half. [1:04:40, 1:04:41]: To get [1:04:42, 1:04:45]: At Bill Gardner Parkway, up Dagles Landing. [1:04:46, 1:05:06]: to get off to get gas and I'm thinking, okay, if y'all don't care about the traffic, I sure do. I'm retired, but I spend most of my time sitting in traffic now. And like I said, all these things that y'all are doing affects all of us. And I don't understand why everybody wants to be all of a sudden unincorporated, wants to be annexed in the city. [1:05:05, 1:05:25]: And what's the benefit of being annexed in the city? I mean what what are our benefits and what's the detriment? So I pay Henry County taxes. If I get annexed into the city, do I then pay city taxes? Okay, so why would I want to be annexed into the city? And so what is the city's budget? Are y'all Mr Dumas, this is [1:05:25, 1:05:26]: Is out the scope. [1:05:27, 1:05:27]: Huh? [1:05:28, 1:05:30]: This is not pertaining to the case. [1:05:30, 1:05:37]: You're right. Well anyway, I just think would y'all please consider the traffic? Thank you. [1:05:39, 1:05:43]: I believe that the lady in the blue was next. [1:05:44, 1:05:50]: It no, no, no, no, no. No, you cut line behind you. These two lateral Yeah. [1:05:54, 1:05:55]: Good catch. [1:05:57, 1:06:17]: Okay, so um again I'm Christina Lovett at 180 Oakwood Circle and that's the property I was talking about earlier. Uh so my question is the town homes that are uh they're trying to put up um as multifamily use, um would they be for sale or [1:06:17, 1:06:37]: rent. Does anybody know the answer to that? They're for sale. So okay. And um what happens with the homes that we currently live in are uh they're just regular residential, not multifamily use, like with just regular houses. [1:06:37, 1:06:44]: Um so what happens with that property? I mean, are they trying to like buy our property out or [1:06:47, 1:07:00]: Okay. And um would there be something like a HOA then? I I know someone was talking about maybe a gated community, I think they had mentioned uh is this [1:07:00, 1:07:01]: Pardon me? [1:07:03, 1:07:11]: Okay, I currently am not in a HOA, so would that change for me under this proposal? Your property won't be affected at all. [1:07:11, 1:07:15]: 'Cause I live right on Oakwood here. Okay. [1:07:15, 1:07:33]: Okay, and um would anybody be able to answer this question? Would our taxes increase? You know, I mean I I know the property taxes are really going up. I mean, we already have people being taxed out of their homes. Okay, thank you. Next question. Tax police. [1:07:37, 1:07:57]: Uh good evening again. Thanking the council so much for uh working with me this evening. My name is Jocelyn Williams. I live at one ninety Banks Drive, Stockbridge. The reason I'm in opposition um of this um development is beautiful and I know it will bring in a lot of people. I'm just concerned I've been here since nineteen ninety-two and Mike concerned. [1:07:57, 1:08:17]: Is the flipping road corridor? Um, there's no infrastructure, there's no widening. Uh, went to uh online, there's nothing for the 2024-2030 um that's gonna be built uh for that area, unless I didn't see is anything being built for the um flipping road corridor to widen or to [1:08:17, 1:08:24]: [4105.4, 4108.1]: But is it anything that you know of concrete? [1:08:30, 1:08:40]: Okay. That's the only reason. Uh we already have a beautiful uh broader farm. They just built that. They just built their um Popeye's chicken and they're building a beautiful um [1:08:40, 1:08:55]: um car wash and I just was in opposition only because I didn't know is there a different frontage to this um gated community? Will there be only one near the Taco Bell? Will they be able to get in and out? Is that only one access? [1:08:57, 1:08:58]: [4138.9, 4146.0]: Okay, I know the frontage would be near the Taco Bell. Is another way that they could get into um their subdivision? [1:09:06, 1:09:08]: There will be an em emergency access. [1:09:09, 1:09:15]: Emergency access but n nothing that the regular residents could use on a regular basis? [1:09:16, 1:09:23]: Okay. I just want to thank the council again and I appreciate you. Thank you so much. Thank you. Next please. [1:09:28, 1:09:38]: Good evening, gentlemen. My name's Cheryl Whitnell and I live in Saint Marguerite. I want to talk to you about three subjects regarding motor vehicle safety. [1:09:38, 1:09:39]: Um [1:09:40, 1:09:46]: We are in the St. Ives flipping road right across from the golf course. [1:09:47, 1:09:55]: When Broto Farms was built and the increase in traffic and population of Henry County. [1:09:55, 1:09:58]: The roads are not able to accommodate. [1:09:59, 1:10:09]: We cannot get out of our subdivisions. I do not believe a thorough investigation regarding traffic was ever done. [1:10:10, 1:10:13]: when this was done because there is no room for expansion. [1:10:13, 1:10:24]: Not only that, um there are trees, bushes that we cannot get out of the subdivision because we can't see and we're halfway in the middle of the road. [1:10:25, 1:10:30]: The other thing is there's nothing to contain traffic between banks and Hudson Bridge. [1:10:31, 1:10:32]: And it's a free for all. [1:10:33, 1:10:37]: We cannot get out, okay? And [1:10:37, 1:10:43]: I you've added Broder, you've added the you've added that um you've got [1:10:44, 1:11:04]: Increased traffic between 138 and Hudson Bridge. So my and there are no traffic, no street lights between Stay Knives and Hudson Bridge. So my request would be a comprehensive study of where uh stay knives and flippin' meet to try to either get some kind of caution sign. [1:11:04, 1:11:08]: stop sign, um anything because somebody's gonna get killed. [1:11:08, 1:11:12]: If they don't cut back those branches, somebody's gonna get killed. [1:11:12, 1:11:14]: Um if they don't install [1:11:15, 1:11:22]: Streetlights, somebody's gonna get killed. These are simple things that should have been thought of when we increased. [1:11:22, 1:11:24]: The population in that area. [1:11:26, 1:11:32]: So I would hope that you would take this tonight and first and foremost have those bushes cut back. [1:11:32, 1:11:34]: Because otherwise [1:11:34, 1:11:37]: We're in the middle of the road trying to make a turn. [1:11:37, 1:11:40]: And I'm sure none of you want that on your conscience. [1:11:42, 1:11:43]: Thank you, ma'am. [1:11:44, 1:11:50]: I'd like to remind the planning commission you can't take transportation issues into consideration when you make your decision. [1:11:53, 1:11:59]: Ma'am, you may take your seat. Is I mean, is there any way you guys can do a traffic study? You may take your seat, ma'am. [1:11:59, 1:12:00]: Okay. [1:12:00, 1:12:01]: Oh, is it weird? [1:12:04, 1:12:09]: But the tank was fine. [1:12:16, 1:12:17]: The public hearing [1:12:18, 1:12:20]: It's not closed. [1:12:24, 1:12:42]: I would need a motion from the commission with regard to comprehensive plan amendment K C P twenty twenty-four-zero one. Mr. Chairman, before we do that, I have a couple of statements to make because the requester is not here. I want to turn my questions into just statements if I'm allowed. Go right ahead, sir. [1:12:43, 1:12:46]: We have the number of units that they're planning on building in this. [1:12:47, 1:12:56]: development, but they don't say how many anticipated residents they're looking to to put in these units. That's one statement. [1:12:58, 1:13:00]: Um course the big issue is [1:13:01, 1:13:04]: egress into the property in and out and [1:13:04, 1:13:08]: Um I wanted to ask the developer if he is prepared to [1:13:09, 1:13:15]: purchase additional properties around this entrance because right now they do not own property to the street. [1:13:15, 1:13:27]: Um the Taco Bell and the bottle shop and I think Walmart owns the property there. Are they prepared to purchase property to put in appropriate uh traffic control devices? [1:13:28, 1:13:45]: you know, at that intersection in the middle of the curve. Um that's kind of what squashed it in the last couple of plans they've had for it. So I was just w gonna I was gonna ask them that, but since they're not here I'm just making a statement that they will have to purchase additional property. [1:13:47, 1:13:50]: No, Mr. Chair, may I speak also? Go right ahead, sir. [1:13:51, 1:14:01]: I I think it's unfair to make any decisions if you if you don't have the client here to answer all the questions pertaining to developing the property. [1:14:11, 1:14:31]: My name is Alex McCart. I'm with Moor Bass Consulting. We have worked some on this project, um, and I was letting the applicant know for some reason they didn't know it was on the agenda tonight. I can't explain all that, but they wanted me to ask for a deferral. So if that's possible. [1:14:32, 1:14:33]: Sure. [1:14:33, 1:14:33]: Thank you. [1:14:40, 1:14:43]: Mr. Chairman, I have a question. Go ready, sir. Um this gentleman here. [1:14:45, 1:15:01]: Just curious if the uh if the developer has held any kind of a community forum to discuss with any of the residents. So that's what kind of the messages I'm receiving. They've hoped to do that before this meeting tonight. [1:15:02, 1:15:22]: Again, I can't explain all the scheduling mishaps, but that's their intent, yes. Okay. I would suggest if possible that they try to schedule a forum, be it a Zoom call, uh something prior to coming here to kind of tamper the emotions, get a lot of the questions out. Uh it's very helpful. [1:15:22, 1:15:23]: I find yes, I agree. [1:15:23, 1:15:25]: Okay, thank you. You got anything else from me? [1:15:27, 1:15:27]: Thank you sir. [1:15:29, 1:15:36]: So I just heard from the uh attorney representing the client on this project. They wish to defer this matter. [1:15:37, 1:15:40]: All right, sir. That's what he just said. Yeah. [1:15:41, 1:15:43]: So having heard [1:15:44, 1:15:49]: I need a motion to defer it. The comprehensive plan amendment case and the resulting case. [1:15:50, 1:15:53]: I would like to present a motion that we defer. [1:15:54, 1:15:55]: Is there a second? [1:15:56, 1:16:16]: It's been moved by Mr. Thibodeau and second by Mr. Mitten that we defer the comprehensive plan amendment case CP twenty twenty-four-zero one and the rezoning case, RZ2024-01. All in favor, let it be known by the sound of aye. Aye. Any opposed? As I have it. [1:16:16, 1:16:18]: These cases have been deferred. Thank you. [1:16:22, 1:16:36]: Next is an annexation case AX twenty twenty four-zero one. Council District Five, the City of Stockbridge Planning Commission will hold a public meeting on Thursday, May sixteenth, twenty twenty four, at six thirty PM. [1:16:37, 1:16:38]: And the city council. [1:16:39, 1:16:55]: The City of Stockbridge, Mayor and City Council will hold a public hearing on Monday, July 8th, 2024, at 6 PM in the Stockbridge City Hall, located at 4640 North Henry Boulevard in Stockbridge, Georgia. [1:16:56, 1:17:03]: To consider a request to annex property on the southeastern corner of Patrick Henry Boulevard, Patrick Henry Parkway. [1:17:04, 1:17:05]: And Holloway Road. [1:17:07, 1:17:15]: The parcels uh subject to this is zero seven one A zero one zero eight eight zero zero three. [1:17:15, 1:17:20]: zero seven one eight zero one zero eight nine zero zero zero [1:17:21, 1:17:32]: zero seven one eight zero one zero nine zero zero zero zero and zero seven one eight zero one zero nine one zero zero zero [1:17:33, 1:17:35]: From Henry County. [1:17:35, 1:17:40]: R three and C three to the city of Stockbridge [1:17:43, 1:17:45]: Uh C three. [1:17:45, 1:18:03]: The applicant is Nathan McGuerty. The property is located in landlot fifty seventy-nine of District Six and unincorporated Henry County and it contains two point six three acres of land more or less. [1:18:04, 1:18:05]: Mm-hmm. [1:18:05, 1:18:08]: Mr Gordon Linton, please. [1:18:08, 1:18:09]: Thank you, Mr. Chairman. [1:18:11, 1:18:25]: Uh my name is Gordon Linton, Planner One for the City of Stockbridge. I'm here to present the annexation twenty four twenty-four-zero one, the CP twenty twenty-four-four, and RC twenty-four-zero four. [1:18:29, 1:18:49]: As he mentioned, the applicant is Mr. Nathan McGerty, and the owner is Holloway Jodico Property Partners. The number of acres is 2.6 acres, and the address of the property is located at Project County Parkway at Holloway Road. The project characteristics, the properties are vacant, and the county land use that [1:18:49, 1:18:55]: Designation is low density, any land land use zoning is C three along with R three. [1:18:59, 1:19:03]: So these are the four parcels parcels that are located here. [1:19:08, 1:19:18]: And this is the joint joint zoning map. The parcels are right here and as you can see it is contiguous with seventy seven and eighty seven Highway Road. [1:19:19, 1:19:30]: twenty five Holloway Road and the two other parcels zero five two dash zero one zero thirty one hundred and zero five two zero one zero twenty three zero zero two. [1:19:34, 1:19:37]: And this is the joint future land use um zoning. [1:19:43, 1:19:46]: And staff recommends approval for the annexation. Mm-hmm. [1:19:48, 1:19:53]: Uh the next one is on the comprehensive plan, C P twenty twenty four dash zero four. [1:19:55, 1:20:03]: Um, the applicant's request is to assign the future Latin use designation of high high density mixed use once the properties have been annexed into the city limits. [1:20:05, 1:20:11]: This is the comprehensive plan amendment for twenty twenty four and this is a definition of high density mixed use. [1:20:14, 1:20:34]: And as you can see, the surrounding land use designations, which with property to the north, which is high density residential, Harring County, high density residential, Stockbridge, properties to the south, mixed use, which is Harring County, properties to the east, low density residential, Harring County, and properties to the west, mixed use, Henry County, and high density mixed use. [1:20:38, 1:20:39]: And staff recommends approval. [1:20:41, 1:20:50]: And last but not least, the uh RZ 2024-04. It is important to note that some of the properties there are surrounded by [1:20:51, 1:21:10]: C three, which is down here in this area by Herring County. And it's also surrounded by PUD. So therefore we recommend that we assign the C three heavy commercial once we annex it to the city. And it also will be consistent with the policy and goals of the EDC. It does meet those requirements. And therefore our staff recommends approval. [1:21:11, 1:21:17]: Thank you. Thank you, Gordon. Any comments, questions from the commission? [1:21:21, 1:21:26]: Uh it is important to note that the uh pro property owner is not proposing any development at this time. [1:21:28, 1:21:29]: Thank you. [1:21:33, 1:21:34]: No questions, no comments. [1:21:34, 1:21:40]: Mr Chairman, since this is the same piece of property we just deferred, would we like to defer this as well? [1:21:41, 1:21:42]: Come again, sir? [1:21:43, 1:21:47]: So since this is the same piece of property we just deferred it's not. [1:21:48, 1:21:52]: It's not the same page. You sure? No. [1:21:54, 1:21:58]: Yeah, Mr. Planchin, this I think this property's over in the overlay district. [1:21:59, 1:21:59]: Probably say. [1:22:04, 1:22:07]: No. No. [1:22:08, 1:22:10]: Okay. I stand corrected. [1:22:12, 1:22:13]: You good? [1:22:14, 1:22:17]: You clear? Yes, sir. Okay, good. Thank you. [1:22:19, 1:22:20]: Thank you, Gordon. [1:22:20, 1:22:21]: Sorry. [1:22:21, 1:22:30]: We will now open this the floor for public hearing regarding the annexation, the comprehensive plan, and the rezoning. [1:22:31, 1:22:38]: Of those these four parcels of Patrick Henry, are they anyone in the building whose [1:22:39, 1:22:40]: In favour of [1:22:43, 1:22:45]: Come right up, sir. State your name. [1:22:50, 1:23:03]: My name is Alex McCart with Moorbass Consulting. I'm uh the agent representing Nathan McGarrity. Uh I'm just really here to answer any questions. We just uh using this to clean clean up some of the split zoning that's here. [1:23:04, 1:23:04]: Thank you. [1:23:10, 1:23:15]: The before you sit down, sir, does any or the commission have any questions for [1:23:17, 1:23:18]: The consultant. [1:23:19, 1:23:21]: No questions? Thank you, sir. [1:23:24, 1:23:26]: Are there anyone in the building who's [1:23:26, 1:23:28]: Opposed to this annexation. [1:23:31, 1:23:33]: Please come forward, state your name and address, please. [1:23:35, 1:23:40]: Connie Snow, four twenty six Chase, Marion Way, McDonough, Georgia. [1:23:40, 1:24:00]: I de I disagree with this request for annexation or any other act annexation that has been proposed for any property on Patrick Henry Parkway. We have currently gone through about two or three right now. These annexations are setting up my community in the Eagles Crest subdivision to be island off. And if you're from [1:24:00, 1:24:20]: Familiar with SB 612, that caveat. So you do have the thing where you could ask to be annexed off if you're a landowner, if you're in a neighborhood that's maybe surrounded differently, you vote for it. But if you're where I'm living right now, you're forcing us into an island, which means if we're forced into an [1:24:20, 1:24:27]: on an island, we get no vote on annexation. And there is not one person in my neighborhood that is a homeowner. [1:24:27, 1:24:47]: That wants to be a part of Stockbridge. And by doing this annexation, we will be forced to become an island. And then we will be forcefully annexed off and a city that we want no part in. And that is our choice. Additionally, I do have a question that I would like everybody to answer tonight in regards to SBC. [1:24:47, 1:25:07]: 612. In 2022, it appeared on a ballot asking if Stockbridge, you wanted to be a part of Stockbridge. A lot of us in unincorporated Henry County believe that that did not appear on our ballot, and therefore we were not allowed to vote on it, but yet we are suffering the consequences of that vote. Can anybody compare? [1:25:07, 1:25:16]: Confirm here today, or can they provide me further research where that appeared on every ballot for Henry County? This is off-scope. [1:25:17, 1:25:19]: You need to let me finish. [1:25:20, 1:25:40]: We are against this. Additionally, we have documented that the city of Stockbridge has constantly changed their comprehensive plan on multiple occasions to fit the needs of developers. At what point does this stop, and at what point do we take care of our citizens? Because where I'm standing and where I'm living, I [1:25:40, 1:25:52]: I am getting pushed into a situation I do not want to be. And I can promise you this, if I become a part of the city of Thoughtbridge, I will not make life easy. [1:25:53, 1:25:57]: Mr. Dilmers, we need to stay on scope. Thank you, Ms. Null. Next please. [1:26:04, 1:26:10]: Tasha Kempel, 410 Chase, Marion Way, McDonough, Georgia, 30253. I do not agree with this. Um [1:26:10, 1:26:24]: I do think that property owners have the right to sell to who they want to sell to, yes. But if it's gonna be a multifamily unit again or a used car lot or a new car lot, whatever it is. [1:26:25, 1:26:34]: I don't think I'm fond of that. But I do know that the traffic getting off of Holloway Road, there's no light there. There's no roundabout. [1:26:35, 1:26:51]: Not even a four-way stop sign. So it's so hard to get out right there. And I'm not driving to Tunis to go to a red light when you got school getting out of and then having all these school buses. So anyways, just looking at this, it's just gonna be more congested. My neighborhood. [1:26:52, 1:26:55]: More people, more crime, gas station. [1:26:55, 1:26:58]: Across the street from the racetracker already had a shooting over there. [1:26:59, 1:27:03]: So I don't know how much more crime that this area is gonna be getting, but [1:27:04, 1:27:09]: I don't feel good about it. Um, that's all I gotta say. Thank you. Mm-hmm. [1:27:11, 1:27:12]: Anyone else, please? [1:27:13, 1:27:16]: The public hearing is now closed. Thank you. [1:27:16, 1:27:17]: Yeah. [1:27:20, 1:27:21]: Any comments from commission? [1:27:31, 1:27:35]: No comments? No questions? [1:27:40, 1:27:41]: I see. [1:27:44, 1:27:45]: Go ahead, Miss Jackson. [1:27:49, 1:28:00]: I just want to remind everyone there is no proposed development. They're only pr um planning to and it's four parcels into the city. No proposed development. [1:28:00, 1:28:01]: That one. [1:28:02, 1:28:04]: Thank you, Ms. Jackson. [1:28:06, 1:28:18]: No further questions, no further comments. I need a motion from the c commission respect to annexation case AX twenty twenty four-zero one. [1:28:26, 1:28:27]: Chairman. [1:28:27, 1:28:38]: Well I sympathize with the uh with the citizens.
