[0:02:44, 0:02:45]: So I would like to uh [0:02:46, 0:02:49]: Call a Monday, February tenth meeting to order. [0:02:50, 0:02:54]: And on that note, please stand for the invocation. Uh Councilman Berry, please. [0:02:56, 0:03:16]: Let us bow our heads. Eternal God, our Father, we thank you tonight. [0:03:16, 0:03:36]: From you. And tonight, Lord God, we pray, Lord God, for wisdom, guidance, and peace. All this in the name of your son Jesus Christ, we pray. Amen. Amen. We're gonna pledge allegiance here. I pledge allegiance to the flag of the United States of America and to the Republic for which it stands. One nation, under that. [0:03:36, 0:03:40]: Indivisible. With liberty just for the same thing. [0:03:40, 0:03:42]: Roll call, please, Madam Clerk. [0:03:46, 0:03:48]: Evening. Present. [0:03:51, 0:03:52]: Present. [0:03:55, 0:03:55]: Present. [0:04:01, 0:04:03]: Thank you, Madam Clerk. Appreciate that. [0:04:03, 0:04:05]: Councilman Berry, sir, you have an amendment? [0:04:07, 0:04:07]: Yes. [0:04:07, 0:04:20]: Ms. Mayor, uh I wanna make a move that we amend to bring executive session up closer into the agenda first so that we can discuss legal, real estate and personnel matters. [0:04:20, 0:04:21]: Is there a second? [0:04:21, 0:04:25]: So moved. Okay. I may second. Okay, thank you very much. All in favor, please indicate. [0:04:26, 0:04:33]: All right, I'm gonna put that uh after our consent agenda right before we get into old business. It'll be a second session. [0:04:33, 0:04:34]: There as well. [0:04:35, 0:04:36]: Okay. [0:04:37, 0:04:41]: Now we need a motion to adopt the rest of the agenda, please. Mayor Ford. Yes, ma'am. [0:04:41, 0:04:45]: I'd like to make a request to amend the agenda. Okay. [0:04:46, 0:04:59]: As I emailed all of you, I wanted to amend the agenda to discuss a new policy or ordinance similar to the program that the city of South Fulton has implemented, the Code CARES program. [0:05:00, 0:05:02]: All right. Is there a second to that uh motion? [0:05:04, 0:05:06]: Is there a second to the motion? [0:05:06, 0:05:07]: Exactly. [0:05:07, 0:05:11]: You must bear second that. All in favor, please indicate. [0:05:13, 0:05:33]: Let me have a clarification really quick if I could. Okay. Okay, sir, go ahead please. So Miss Barber, if you would, we gave the chief six months to come up with a program. I'm sorry, Councilman Alexander, this is to amend the agenda to have the discussions. [0:05:33, 0:05:42]: Your questions can be addressed during the discussion. Well if you want me to address the question. So I just want to add this item to the agenda. [0:05:43, 0:05:47]: All right. Motion been made and seconded. So all in favor of the motion please indicate. [0:05:49, 0:05:57]: All in favor of the motion, please indicate. Motion motion fails. All right. Now I need a motion to uh adopt the rest of the agenda uh for this evening, please. [0:06:00, 0:06:02]: I mean so I think is your second. [0:06:03, 0:06:06]: Second. Okay, ms Mr. Berry, second dad. All fair, please indicate. [0:06:07, 0:06:27]: All right, thank you very much. On that note, uh earlier part of the uh evening and we gave the ceremonial review and that was dealing with Black History Month, the proclamation. What I mentioned to the uh individuals that were here earlier is that we in the city Stockbridge have given out proclamations, having given out proclamations all year long for all different types of [0:06:27, 0:06:47]: uh individuals and and uh I guess you say support and assistance to whether it's domestic uh violence month and whether it deals with any other uh nationalities or ethnicities in our community, uh Hispanic Heritage Month, Pacific uh Asian Month, um the once again domestic violence, women's history month. [0:06:47, 0:06:53]: We've always done it, we will continue to do that to support and and acknowledge our community and diversity of our community. [0:06:54, 0:07:14]: Uh so I want you to know that um that we would kind of do that. And actually when we give our proclamations, whether it's here or any other individuals, uh our clerk office does an excellent job because they're always framed. All right, so that's that's a that's a special thing that we do. So we will continue to do that and to uh honor our individuals and uh and our diversity. [0:07:13, 0:07:28]: Within our community. Outside of that, I swore in three individuals to the Stockbridge Youth Council, Ms. Candace Jones, Georgia McIntyre, and Alicia Gables, and they're going to join the youth council. So we accomplished that. [0:07:28, 0:07:30]: Ms. Holliday, do we have any public comments at all? [0:07:34, 0:07:36]: Ms. Do we have any public comments at all? [0:07:47, 0:07:48]: Yeah. [0:07:50, 0:07:51]: Mm-hmm. [0:08:08, 0:08:26]: Okay, thank you, madam clerk. Appreciate that. Council, I have the option of minutes. Uh that's January eighth, twenty twenty-five, the council retreat minutes, January thirteenth, twenty twenty-five, the council minute uh meeting minutes, and also the work session meeting minutes on January twenty eighth. I have a motion to approve those, please. Okay, Mr. Berry to Mr. Alexander. All in favor, please indicate. [0:08:28, 0:08:36]: Okay. Uh you there's staining yes ma'am. Um I did not attend the retreat. [0:08:36, 0:08:42]: I was gonna ask if you could call for a vote with each of these meeting minutes separately. [0:08:44, 0:08:52]: All right, we can do that. What what okay. Okay, the adoption of the January eighth, uh, twenty twenty five council retreat minutes. Uh I need a motion to accept that. [0:08:53, 0:08:56]: Mr. Berry? Second. Okay, Mr. Alzheimer's. Are you all in favor, please indicate? [0:08:59, 0:09:00]: Epstein. [0:09:00, 0:09:01]: I'm sorry? [0:09:02, 0:09:02]: I'm sorry? [0:09:03, 0:09:04]: I can vote. [0:09:04, 0:09:05]: Okay. [0:09:09, 0:09:17]: Well actually I guess that is correct. You know, I'll vote to approve the minutes. Thank you, sir. I'll vote to approve the minutes. [0:09:17, 0:09:19]: Yes, ma'am. [0:09:20, 0:09:23]: [563.5, 566.1]: As votes. It's almost as if we're not here. [0:09:27, 0:09:47]: It has to be two who opposed and two who approved. Okay, so do you opposing or approving? Are you opposing or abstaining? I am abstaining. Okay, so then I don't have a t I don't okay. There is no tie. Okay. I got it. Understand? Got it? But you can consult with the city's legal attorney? No, I don't need no, I don't need to do that. I got it. If you you if you [0:09:47, 0:09:52]: You're standing, you're abstanding. All right? No problem. So otherwise on that, ladies and gentlemen, not [0:09:54, 0:09:54]: Miskat. [0:09:55, 0:10:15]: Mayor for even from my understanding through legal and one of the GMA classes I just took, by the way, that even though I didn't attend the meeting, as long as my colleagues are agreeing that these are the things that are taking place, I can vote in the affirmative You you could. And so I'm gonna go ahead and vote affirmative. I I'll let it pass. [0:10:15, 0:10:24]: Now we're going to adoption of the January 13 minutes, 2025, Council meeting minutes. All in favor, please indicate? Well, first of all, as I'm sorry, is the move? Okay. [0:10:25, 0:10:25]: Mr. [0:10:25, 0:10:28]: Okay, from Mr Alexander Mr. Barrett, please indicate. [0:10:28, 0:10:40]: All right. United decision and also January not twenty sixth, excuse me, January twenty eighth, twenty twenty five, council work session minutes. I need a motion to accept that. Is there a second? Second. Okay from Miss Gantt to Mr. Dallas and I'm fair, please indicate. [0:10:40, 0:10:42]: Okay, now she says, All right. [0:10:42, 0:10:42]: No [0:10:43, 0:10:44]: We good now, Madam Clerk? [0:10:45, 0:11:05]: Thank you very much. Okay, consent agenda. We have a council of consideration appoint a member of the Stockbridge Youth Council Advisory Committee for a two-year term. That's Dr. Elisa Green, and also Council of Consideration appoint a member of Stockbridge Public Facility Authority Board for a four-year term. And that's Miss Talisa Toseka. [0:11:05, 0:11:07]: Thomas, if I got it spelled right or pronounced right. [0:11:07, 0:11:20]: Um that's on the consent agenda. If there is no problem with that, I need a motion to accept these two ladies to join these committees. So moved. Is there a second? I second. Okay, from uh Ms. Gat to Mr. Berry. All in favor, please indicate. [0:11:21, 0:11:24]: Okay, now it's the season. Okay, fantastic. We'll move on. And now [0:11:25, 0:11:28]: Now we're going to a second session. I need a motion to go into second session, please. [0:11:30, 0:11:42]: Mayor, I move that we go into executive session for um litigation personnel and real estate. Thank you very much. Is there a second? Sir. Mr. Alzheimer's second. All favor, please indicate. Okay, ladies and gentlemen, we'll be back. Thank you. [0:11:50, 0:11:54]: Yeah, and that was gonna go to the I do I think. [0:12:03, 0:12:05]: Got it. [0:12:06, 0:12:08]: Oh who is it? Come on now. [0:12:20, 0:12:25]: I tell you what. Um all right, council, I need a motion to end our executive session, please. [0:12:26, 0:12:30]: So moved. There's Ms. Bar from Ms. Canton, Ms. Bar, all in favor, please indicate. [0:12:31, 0:12:41]: Now I need a motion to reconvene our council meeting. So moved. Okay. Ms. Barber second that as well. All in favor, please indicate. Thank you very much, ladies and gentlemen. Okay, we'll move on. Uh oh by the way, we have nothing to [0:12:41, 0:13:01]: Audience, we have nothing to report from our second session at this time. So we'll move on with our old business, which deals with a special use permit case sp-2024-02, located in Council District 4. Note this is be considered as a board vote only once um only once the public hearing is already held in November 12th, 2024. [0:13:01, 0:13:10]: Consideration of special use permit request is to allow a liquor store on the property of 106 Rock Croy Road. Applicant GRP LLC agent [0:13:10, 0:13:27]: Okay, Mr. Patel. And the first name is Homdinger for me to r try to pronounce here. The probably located landlock sixty two of District twelve contains point uh zero uh excuse me, point uh eight nine acres. Mr Anderson, please. Uh Mayor, no. Yes. [0:13:27, 0:13:33]: I'm sorry. Can I get the vote count for my request to amend tonight's meeting agenda? [0:13:34, 0:13:43]: I know that it was seconded. I know the motion failed. But I wanted to I didn't get the vote of Councilwoman Gantt or Councilman Alexander. [0:13:44, 0:14:04]: Did they abstain? No. Did they oppose? No, no. I just didn't. Two to two. No, no, no. It's the one the one you uh you abstained from one. What the first one that came up, then what happened is that then then Ms. Gantton voted. So it's three zero one on that first one. Everybody on the first you're talking about for the meeting minutes. No, sir. I'm talking about my motion. [0:14:04, 0:14:05]: Right. [0:14:05, 0:14:07]: To amend tonight's agenda. [0:14:07, 0:14:10]: To discuss the code care's policy. [0:14:11, 0:14:25]: I made the motion. I don't think the motion was Mr. Berry seconded the motion. I just want to hear what the clerk had in reference to Councilwoman Gantt and Councilman Alexander's vote. That's all. [0:14:27, 0:14:33]: Okay, so how do we know if it failed or hold hold a second let miss Gray Miss Holdi? [0:14:42, 0:14:43]: Todo [0:14:45, 0:14:53]: You voted in favor as well? Oh you did vote in favor? I voted I saw that you seconded the motion, but I did not see where there were any vote. [0:14:54, 0:14:55]: Oh, I select the hand holder. [0:14:55, 0:15:04]: So may I ask Councilwoman Gantt and Councilman Alexander what their vote is? The vote. Whether they're abstaining or opposing. [0:15:06, 0:15:19]: I asked for more information initially I said that I would vote against it because I did not have the information that I had requested. Okay, so and Miss Cand, I would think uh [0:15:21, 0:15:22]: Well, honestly [0:15:24, 0:15:32]: I thought that this wasn't the right day and time to discuss it. I think that if you're gonna discuss it maybe in work session w we have a [0:15:33, 0:15:36]: quite lengthy public hearing agenda. [0:15:36, 0:15:45]: In addition to that, we did already speak with the police department and allow them to have six months to get [0:15:46, 0:15:49]: their program and process in order [0:15:49, 0:16:09]: So I wanna give them that opportunity that I actually I was actually the person who asked that uh that we give them that chance. So I wanna give them that opportunity to get that in order first. Um but I uh that was number one and number two, I just think that it should be on the work session agenda. Right. [0:16:09, 0:16:16]: So otherwise, uh Ms. Mr. Washington, it looks like we have a, I mean, I thought we documented this, it looks like we had a two-two tie on this. [0:16:17, 0:16:25]: All right, so if that's a two two tie then uh if that's the case. I just need clarity on what their vote is. Are you opposing amending the agenda? [0:16:25, 0:16:28]: Are you abstaining from amending the agenda? [0:16:28, 0:16:48]: In adding this item for discussion or not, that's that's all I want. Just clarity. What on what their votes are. You the motion was made by you, second by Mr. Berry. You and Mr. Berry voted uh affirmative, why now Ms. Gantt and Mr. Alexander voted uh down. And so two times. Yes by opposing? Yeah. I opposed for today. Okay. I I did. [0:16:48, 0:16:53]: Okay, so I'll just bring it back during the work session. [0:16:53, 0:16:54]: Thank you. [0:16:54, 0:16:57]: Well wait a minute. Is it is it not a two two tie? [0:16:57, 0:17:03]: Okay, then I I vote to turn it down as well, make a three two. That's my vote, and then let's move on. Okay? Three two and let's move on. [0:17:03, 0:17:12]: I Mr. Anderson, it's on you, sir. Uh at the last council meeting we had um we had the public hearing process uh for this item and all that is left is uh the vote. [0:17:14, 0:17:22]: Okay. Uh I any pr other presentation, d uh any other attorneys or any other information for presentation on this issue? [0:17:22, 0:17:23]: Voilà, make a vote? [0:17:24, 0:17:25]: Did you want to come forward, ma'am? [0:17:26, 0:17:27]: Okay, name and address please. [0:17:29, 0:17:49]: Lisa Moore shower for Mr. Patel and his entity. Um we would like very I'm sorry. Is it is it on? I just wasn't near it. Thank you. Okay, thank you. Um I did send a chronology of based on the last council meeting when y'all asked some questions. I sent a chronology of I went through all [0:17:48, 0:18:08]: The ordinances that were related to the lottery, and I sent a chronology with all the times that I thought were important for you to understand what had happened. Um, so in March, March 26th, 2024, the city council voted through an ordinance to um ordinance number OR 24560 to um enact a lottery to allow for [0:18:08, 0:18:28]: To allow two more licenses for the city because the population had grown and that's what your code says. So I gave um I don't know if you have the exhibits, but A and B, one A is the minutes of the meeting and B is the actual certified copy of the ordinance, which we which we've gotten from the clerk's office. [0:18:28, 0:18:48]: And then on April 6th, based on that ordinance, um there was a legal advertisement stating this stating the streets for which the licenses would actually be allowed to be applied for. So in the legal ad on April 6, 2024, it specifically said Rock Quarry Road and Jo Jodico would be the two streets. [0:18:48, 0:18:50]: Про впливаються воді акте. [0:18:51, 0:18:53]: Анден африта хапан. [0:18:53, 0:19:13]: The city did some additional um notices to the applicants, potential applicant pool who were going to apply for the licenses. And then there there was some information put on the website on April 17th, 2024. And then on May 1st, 2024, my clients applied for a spot on 106 Rock Court. [0:19:13, 0:19:28]: Road in in compliance with what the ad had said and what the information from the city had said. And then on May 3rd, 2024, another second notice went out to the applicant pool with some additional information from the city. [0:19:29, 0:19:32]: And I didn't give you that information in your pac in the packet, but um [0:19:32, 0:19:43]: But it did mention that there had to be a specific address in the applications that were submitted to the city. And my client had put his address in there, but I think the city had had gotten some [0:19:43, 0:19:46]: Аплікація з дитинтам. [0:19:46, 0:19:53]: And that wouldn't wouldn't be very helpful as you're s pursuing and parsing through the applications to figure out which one would meet. [0:19:53, 0:19:55]: And comply with the code section. [0:19:56, 0:20:03]: So then on June seventh, all the applications had to be filed by the end of the business day. And my clients had already been filed, so he was in. [0:20:03, 0:20:08]: And then on July thirtieth of twenty twenty four this council had a meeting. [0:20:08, 0:20:18]: um where it enacted um two things it enacted an ordinance um or twenty four seventeen twenty four which expressly approved [0:20:18, 0:20:38]: Rock Quarry Road and Jodico Road as the two locations for which additional applications would be accepted for alcohol licenses. And they're listed in the code in that legislation. They're named in it. And then there was a resolution, R241724, which specifically approved Mr. Patel, my client, and another [0:20:38, 0:20:58]: Another Mr. Patel's applications for processing. So that night was really important for my client because y'all voted for those two locations to be on those streets, those two new locations to be on Jodico or Rock Quarry Road. And my client is on Rock Quarry and he's in the in the area which was allowed and approved. And that was one of the things. [0:20:58, 0:21:18]: That came up last or the main thing that came up last at last city council meeting was that Councilmember Barber said she didn't know that that was that the address was uh approved, but it was done through an ordinance and it was voted on unanimously and it was listed in the legislation. So I and my applic my client's application also listed the code. [0:21:18, 0:21:20]: I mean the address. [0:21:20, 0:21:40]: And the legal ad also had the address. So I think there's a a lot of information that was given about which addresses could be could be utilized or which streets could be utilized for new licenses. Um so that so there was also a question from um Councilmember Gantt about the work on the property. I also submitted an email um from [0:21:40, 0:22:00]: My client to Ryan Anderson that some said that um no he had done no work outside uh I'm sorry, no work inside the property. He only had done work outside the property with with now he's got the tree permit um that he needed to get for the the business that was cutting the trees down. So no work has been done that was not permitted. [0:21:59, 0:22:07]: I just wanted to be make make that clear. And I submitted pictures of what had happened in the back. And that's the only work that's happened. So [0:22:08, 0:22:22]: I I'm happy to answer more questions, but we feel like if if you don't approve this application, you're violating constitutional rights of my client. I've I've submitted an um constitutional objection statement, but I think that it would be [0:22:22, 0:22:42]: A going against your own code, which you've already approved and legislated, you've approved these two locations. My client meets those requirements. He meets all the requirements of the alcohol code as well. Um, I know he still has to go through that process, but this SUP is the beginning of that process, and y'all approved, you have opened it up to get. [0:22:42, 0:22:52]: two new licenses and my client applied for one of the spots that's legal for your city because you approved it. Y'all you have already approved this location as being [0:22:52, 0:23:12]: uh in the street or on the street that was approved for a license for a new license. So it would be unconstitutionally um violative of his rights, his due process rights, his equal protection rights. It would be a taking of his property. It would be in violation of your your duties as council members to deny it based on the based on the [0:23:12, 0:23:27]: the location for sure. And I've I've said everything else in my uh statement of objections a couple of times ago that I submitted. So I think I'm I'm done unless you have questions. Well right. So any questions at all, Council? [0:23:28, 0:23:29]: Anybody? [0:23:31, 0:23:34]: Okay, no questions. Is there a motion to uh approve this or not? [0:23:37, 0:23:48]: And I just want to make sure my new documents get into the record. I did give them to our c your clerk. All right. But it's um a memo it's a memo I wrote with the timeline and then exhibits A through F. [0:23:50, 0:23:52]: I need a motion to approve or deny. [0:23:54, 0:24:12]: Sir. Yes, sir. I'll make a motion to I make a motion to deny this application that has been brought forth to us. Um and that's my motion. Thank you. Is there a second of the motion? Second. Mr. Berry, second. All favor please indicate. [0:24:13, 0:24:14]: Nam's decision. [0:24:15, 0:24:15]: Is denied. [0:24:16, 0:24:17]: Thank you. [0:24:18, 0:24:18]: Public hearing. [0:24:21, 0:24:32]: Please mute uh all cell phones or other electronic devices. If anyone wishes to speak tonight on a public hearing item, please fill out the form available on the table and hand it to the city clerk before approaching the podium. [0:24:33, 0:24:44]: After each case is called the council will hear from the city staff, followed by the applicant of or their representative regarding the proposed plans for property along with or any other relevant information. Following the applicant, anyone who wishes to speak in favor or oppose the case will have the opportunity to do so. [0:24:54, 0:24:59]: Each side will be allotted ten minutes total. [0:25:51, 0:25:56]: If questions are raised, the council may ask the applicant to address these questions and and or concerns. [0:25:56, 0:25:58]: The presiding officer will call for a motion. [0:25:59, 0:26:08]: And a second to the motion and have any necessary discussion. If the matter is not tabled, presiding officer will call for a vote to recommend approval or denial of the request. [0:26:10, 0:26:12]: First item for public hearing. [0:26:12, 0:26:13]: Item number four. [0:26:13, 0:26:18]: The docket is adoption of the twenty twenty five official zoning and land use map. [0:26:18, 0:26:19]: Citywide. [0:26:20, 0:26:40]: Consider me consideration and adoption of the twenty twenty five official zoning map and twenty twenty-five future land use map to be a compliance with the Unified Development Code, UDC, which includes the city zoning ordinance. Mr. Ryan, please. Excuse me, Mr. Anderson, please. Uh what I have before you tonight is um [0:26:40, 0:26:52]: the recent changes to our all the recent rezonings, um land use changes and an annexations that have occurred since the last time we adopted the zoning maps. So [0:26:53, 0:27:13]: On what you see on the screen is the list of is uh a spreadsheet of all the changes. All these changes were approved by council through rezoning, um, annexations, and um land use changes. So all I'm all I'm doing come all I'm all I'm doing tonight is coming before you to ask you to adopt uh the twenty twenty [0:27:13, 0:27:15]: Five lanes and uh rezone him out. [0:27:17, 0:27:28]: Okay. Council, any questions for Mr. Anderson at all? Yes. During these times here, it is critical because I'm everybody tuned in and everybody who bothered to show up. [0:27:28, 0:27:37]: Is that these decisions sometimes are very difficult for us. And understanding that there is a plan. This is the plan, right, Mr. Anderson? [0:27:37, 0:27:55]: Yes, sir. So what we do is we try to get with together with consultants, the staff, consultants, and experts to put together the best program after a series of public meetings uh over time, because we had numerous public meetings on the comprehensive plans, correct? [0:27:55, 0:27:55]: Yes, sir. [0:27:56, 0:28:06]: so that the public could give input and feedback on what they wanted to see the community look like. This map is actually required under the we're under the under the law, correct? [0:28:06, 0:28:26]: Yes it is. And the reason that we do this and again we have lots of public participation so that the public can weigh in on what you want the city look to look like. Because when developers come to us and they apply, they're applying based on what you said as the public and the consultants and [0:28:26, 0:28:46]: The staff put together to under the legal requirement. Many times our hands are tied in terms of what we wanted to see there, so we tried to make sure that we came up with the best scenario possible in order for us to be able to maintain the quality of life for us. Many of y'all have questions. [0:28:46, 0:29:06]: About how do we end up with their warehouse over uh on Candler Road. Well, there was already zoned for that way well before any of us took a seat up here. Well in I think it's 1999 or 2000. So that was long before us, and there was nothing that we could do about it to uh actually end up in that situation. I just like to make [0:29:06, 0:29:26]: Perfectly clear what we're doing is we're putting together the plan on what on how we're going to move forward with development in the city of Stockbridge. After numerous public meetings, the staff and consultants sat down and tried to meet the legal requirements for us to put forward. [0:29:26, 0:29:34]: This thing called the flume, which is the f future land use map, dictates who can build what and where. Is that correct? [0:29:34, 0:29:38]: That's correct, sir. Okay. Thank you. Any questions from Mr. Anderson? [0:29:41, 0:30:01]: Okay, so this is uh a public meeting, so I need to open for any comments. You ha you are right right now, sir. Yes, sir. I just wanted to let you know that the planning commission approved this. Okay, thank you very much. So I need uh anybody this public hearing, so anybody that has any comments uh for this, comments for this on my far left side. My far left side, I need for you to stand up and uh [0:30:01, 0:30:07]: uh on and line up in this sign and it'll give you the time to speak. Anybody in the middle have any comments for this? [0:30:08, 0:30:18]: Anybody in my far right comments for this? Seeing nothing. Anybody comments against this, okay? My far left side. Any comments against? Anybody against in the middle? [0:30:19, 0:30:24]: Okay. Stand by one second, please. Anyone in the farm? Right side. [0:30:24, 0:30:30]: Okay, you're the only one. Comments uh against this particular project, this approval. Name and address please. [0:30:30, 0:30:50]: Good evening. My name is uh Jocelyn Williams, 190 Banks Drive, Stockbridge, Georgia, 302 81. Um, excellent job. My uh opposition is I would like to know that whenever plans are made that the public would like to know and make um comment. [0:30:50, 0:30:56]: Comments about water, quality, soil and infrastructure. Thank you. [0:30:57, 0:30:57]: Thank you. [0:30:59, 0:31:00]: Mr. And Mr. Anderson, please. [0:31:06, 0:31:09]: Water soil and infrastructure. You can have that, sir. [0:31:09, 0:31:29]: Yes, sir. Uh I'll let our let it's taken care of during the due diligence process before uh a LDP is issued or before a building permit is issued. And also when they submit their rezoning application, they have to get a uh a water letter from Henry County. And when they go to the LDP phase, they have to send their um their plans to Georgia Soil and Water. [0:31:29, 0:31:43]: water conservation and they have to approve them. So they check out on the s they uh do a a review of the soil samples and uh the water is done by the the issuing water authority, whether it's Clayton County, Heron County or City of Stockbridge. [0:31:43, 0:32:03]: All right. And those have to all be done even prior to us them coming to us or prior to coming to the land commission, right? Well some of uh the water is done before it comes to you, but the other uh the water quality and I mean um the erosion control is is taking place. That that d that uh review takes place during the l land disturbance permit phase. Okay. So it's [0:32:03, 0:32:16]: Everything is checked out before they start the bill. All right, thank you, sir. Yes. All right. Uh well on that note, Council, that was the only comment, uh need a motion to to approve if that's the case. So move. Okay, Mr. There's a second. [0:32:18, 0:32:20]: Mr. Barrett, second, all favor, please indicate. [0:32:22, 0:32:42]: Okay, you now have your series. Thank you, Mr. Anderson. Okay, we'll continue on public hearing. This deals uh the next three items deal with council district five. Annexation case AX-2024-02 for one seven seven eight and one-eight seven two highway forty-two north. Once again, council district five consideration. [0:32:42, 0:32:50]: of annexation requests for two parcels at one one excuse me one seven seven eight and one eight seven two [0:32:50, 0:32:59]: Highway 42 North to allow for the construction of a mixed-use development, which would contain single-family detached homes, townhomes, bungalows, and commercial uses. [0:32:59, 0:33:09]: Owner Rowan Properties LP, Applicant Millich, Meredith, Holmes, C O Clay Kirkly, Agent Halen Todd, PEC. [0:33:10, 0:33:25]: The property is located landlock 35 in district seven, contains forty-eight point five nine five nine acres presented by, well, Mr. Addison will present this. Once again, on the comprehensive plan amendment case, CP-2024-09. [0:33:25, 0:33:29]: for the seventeen seventy eight and eighteen seventy two highway north. [0:33:29, 0:33:34]: Once again, Council District Five Consideration and Comprehensive Plan Amendment Request. [0:33:34, 0:33:54]: To assign for the future land use designation of medium density mixed use of two parcels at 1778 and 1872 Highway 42 North after their annexation into the city of Stockbridge from unincorporated Henry County to allow for the construction of a mixed-use, mixed residential development, which would contain a single-family detached. [0:33:54, 0:34:14]: Homes, townhomes, bungalows, and commercial uses. Owner, Rowan Properties LP, Applicant Meritage Home CO, Clay Kirkland, Agent Haley Todd, PEC. The property located landlock 35 in District 7 contains 48.59 acres. And also the rezoning case, RZ-2024-2. [0:34:14, 0:34:23]: 10 for two parcels once again 1778 and 1872 Highway 42 North, Council of District 5, consideration rezoning request. [0:34:23, 0:34:27]: to assign the zoning districts uh for PUD Plan Unit Development. [0:34:27, 0:34:31]: And PMU Parkway Mixed Use Overlay District. [0:34:31, 0:34:51]: Of two two to two parcels at 1778 and 1872 Highway 42 North after an annexation of the city of Stockbridge for unincorporated Henry County to allow for the construction of mixed residential development, which would contain a single family detached homes, townhomes, bungalows, and commercial usage. Once again, owner Rowan Properties LP, Meredith Home, CEO. [0:34:51, 0:34:55]: Clay Kirkley, Agent Haley, Todd, P E C [0:34:55, 0:35:15]: Properties located in landlock 35, district 7. Contains 48.59 acres. Now, Mr. Anderson, on you, sir. Okay. Thank you. Um I'll present the annexation portion first. Um currently the current use of the property, there's an existing house. It's located at 1872 Highway 42 North. The property is 17. [0:35:15, 0:35:18]: [2118.4, 2123.7]: featuring featuring a stream on the northern po parcel and also includes a house and a cemetery. [0:35:24, 0:35:31]: The current um zoning is RA like the mayor previously mentioned, and the uh land use is high density suburban. [0:35:32, 0:35:40]: Here's a vicinity map of the um of the area. And highlighted in red is the is the subject property. The subject properties that we're discussing tonight. [0:35:42, 0:35:45]: And uh also as the surrounding businesses. [0:35:47, 0:35:51]: Okay, here's the aerial photo of the uh with the site plan. [0:35:55, 0:35:57]: Here's a survey of the parcels. [0:35:58, 0:36:02]: Here's proof of the signs, uh where s signs were posted. [0:36:08, 0:36:20]: Uh Meritage Home seeks to annex two parcels located at seventeen seventy eight and eighteen seventy two, Highway forty two north from unincorporated Heron County to Stockbridge for mixed use development. [0:36:20, 0:36:40]: The development will feature 168 units, including 71 single family detached, 15 bungalows, and 82 townhomes, with a density rate of 4.2 units per acre. The proposed square footage for the bungalows is 3,500 feet with a front yard setback of 10 feet and a rear yard setback of 5. This is strange. [0:36:42, 0:36:42]: Here's another [0:36:44, 0:36:45]: version of the site plan. [0:36:47, 0:37:00]: Here's a colored version of the site plan with the layouts. As you can see right here, by my cursor, this is where the single fam 71 single family detached units will go. This is where the 82 townhomes will go. [0:37:01, 0:37:04]: And the commercial component will be located on this side. [0:37:04, 0:37:04]: Mm-hmm. [0:37:12, 0:37:15]: Here's some renderings of the of the of the potential homes. [0:37:20, 0:37:25]: Um the Planning Commission recommended approval and staff also recommended approval for the indexation. [0:37:27, 0:37:32]: Now I'll go into the comp land p uh portion. Here's a copy of the um the land use map of the area. [0:37:36, 0:37:43]: This is a joint future land use map of the area, including Henry County and um City of Stockbridge land use categories. [0:37:51, 0:37:53]: Uh staff recommended approval of the um [0:37:55, 0:37:56]: Of the complain. [0:38:09, 0:38:10]: Okay. [0:38:11, 0:38:31]: Uh as you can see the surrounding land use densities. You have um the Mouse Point subdivision, which has 125 units with a density of 1.71 units per acre. The summit of Eagles Landing, they have 308 units with a density rate of 1.96 units per acre. You have Clark Meadows, they have 141 units with a density of 2.7. [0:38:31, 0:38:51]: You have Eagles Hills with 80 units with a density rate of 4.08 units per acre. Magnolia at Eagles Landing, they have 189 units at 1.84 units per acre. You have Winding Creek with 118 units at 3.06 units per acre. You have Crown Walk with 30 units. [0:38:51, 0:39:11]: with 1.10 units per acre and you have vine yards at Eagles Landing, 215 units with 2.3 units per acre. And the proposal has Meritage Homes project has 168 units with 4.2 units per acre. So as you can see that um the densities are not out of the proposed density is not out of line. [0:39:11, 0:39:17]: As a result, um staff recommended approval of the land use change as well as the planning commission. [0:39:26, 0:39:46]: Uh now that applicant uh I will go to the rezoning portion. The applicant is seeking to rezone to PUD from uh Henry County's mixed use development. Uh PUD is the similar zoning uh that the that the city has, similar to uh Henry County's mixed use development. And as required by code, uh you have to assign a a zoning designation that is similar. [0:39:46, 0:39:48]: to the existing zoning from the county. [0:39:55, 0:39:59]: So here here's another copy of an aerial photo. Highlighted in blue is the site. [0:40:03, 0:40:03]: Um [0:40:07, 0:40:25]: So staff recommends the Planning Commission recommended approval and the staff recommends approval to assign the PUD with conditions. The subject property shall be developed similar to the site plan that was submitted by the applicant on January twenty-first, twenty twenty-five. The bungalow lots located on [0:40:25, 0:40:27]: Lots one through fifteen of the site plan. [0:40:27, 0:40:28]: Shall be three sided brick. [0:40:29, 0:40:49]: A landscaping plan shall be submitted. A ten foot external sidewalk and an eight foot internal sidewalk shall be installed. The building facing the street on campground road shall be three-sided brick. The buildings labeled dining penteo on the site plan must adhere to the parking standards found in section four point one eight of the Stockbridge Unified Development Code. [0:40:49, 0:40:53]: No more than one hair salon, barber nail salon shall be in the commercial section. [0:40:53, 0:40:56]: No event centers, no gas stations shall be allowed. [0:40:56, 0:41:08]: The applicant must combine the two parcels located at 1778 and 1872 Highway 42 North. In addition, no permits shall be issued by the City of Stockbridge until the developer provides a copy of the recorded plan. [0:41:09, 0:41:10]: So the applicant is here. [0:41:10, 0:41:30]: Okay, before we get to the applicant, then counsel, we got any specific questions right now from Mr. Anderson before we get to the applicant. I just wanted to make a statement, if I could. Sure, go ahead. This process has been a long and uh played out. We asked them to come back. Initially, this process involved a 100% residential neighborhood. [0:41:30, 0:41:50]: Certainly that was not the desire of the community. We wanted to uh actually bring a mixed use product and they we suggested that that's what would be brought forward. Uh, because in the area and let me let me be transparent and clear, this is right down the street from my house, which uh on Campground Road uh is basically about um [0:41:50, 0:42:10]: Maybe about a mile or less than a mile from my house. So when people say you make these decisions and you put this in somebody else's neighborhood, or you put this somewhere else, no, these rezonings happen very close to us, and we have to make these decisions in the best interest of the entire [0:42:10, 0:42:30]: Public because that's what our charge is to do. And Mr. Anderson just showed us what the map was gonna look like for the future land use map. The project that was brought forth for us, and I had some comments that were made: was you know, this is what you know, they wouldn't do this in COVID. [0:42:30, 0:42:50]: County. As a matter of fact, this is exactly what they did in Cobb County. If you look at the map uh for the Willowcrest neighborhood over in Mapleton, the townhome product is very similar to that and basically meets the same standards, such as the bungalows uh as well. So if you were looking at uh [0:42:50, 0:43:10]: what the standards look like in some of the northern territories. This is what the same product that we would get here. Too many times we get product that is not uh on that same level, but this product uh certainly is. And when I say that this product is close to me, it is. The property is because this is located right across the street. [0:43:10, 0:43:30]: from the food bank that we operate. So I'm very familiar with this property and understand that the homeowner has been living there for as a house over there and their desire is to move on from the property. And certainly that is uh the intention uh and we are trying to do the very best that we can [0:43:30, 0:43:50]: to work through and with the developer and the community to try to strike a balance to get the very best uh neighborhood that we possibly can. And I think uh what you will see come forward uh is quality and certainly that was the pre that was the number one goal here and certainly [0:43:50, 0:44:10]: The desire was to have a tenant such as a grocery store in the area, not just neighborhood uh type of development. And I think we discussed some additional changes as far as uh earlier today, which is under the highway corridor plan, which is what we this is a highway corridor. [0:44:10, 0:44:30]: Corridor neighborhood, correct? Yes, it's located in Parkway. Make sure you're right in the car in the parkway corridor neighborhood. The neighborhood has the the community has a restriction. The neighborhood parkway has restrictions on various buildings that can or cannot be located there, correct? Yes, sir. That's correct. Also we have a distance limit on certain businesses like [0:44:30, 0:44:41]: Like nail salons, uh barbershops and salons, is that correct? Yes sir, and pawn shops and within within one mile of this location. Yes sir. There's three barbershops. [0:44:42, 0:45:02]: There's two nail salons and there's three hair salons within one mile already today. So the city's prohibition on those um particular instituular um requirements would be in place here today in order for us to be able to to move [0:45:01, 0:45:12]: for cause certainly the desire is understanding to strike a balance. And I think we have some discussion about the grosser because the highway park parkour corridor [0:45:13, 0:45:33]: Prohibits gas stations directly from being located there, correct? Yes, sir. But we gasoline coming up. We did certainly as we did with Costco, uh along the Parkway corridor. If you open up a substantial business where gasoline is a secondary item, not the main purchase, like it [0:45:33, 0:45:53]: The convenience store, gasoline is like the top item that people stop there for. If a Kroger wanted to locate it here or Ingalls wanted to locate here, Aldi or Ingalls, like y'all have on Walt Stevens over there, they could install gas pumps there, but nobody else could just open up a convenience store here under the requirement. [0:45:53, 0:46:13]: requirements that we will have in place here because that's going to be part of the conditions on what we do. And certainly neighborhood uses and the restrictions on the um highway corridor are there for a reason so that we can get uh high standards in doing what we need to do in order to uh move forward. [0:46:13, 0:46:33]: Now, certainly we understand uses as I indicated earlier. Certainly you're gonna have things like sit-down restaurant where you have a restaurant without a drive-thru, or you might have a restaurant in the area, because there aren't any restaurants between McDonough and Stockbridge right there in that location. You may have a fast food restaurant there. [0:46:32, 0:46:52]: Certainly, that would be appropriate as a neighborhood use for the generic for the area, along with some office as well. So there's been a lot of push and pull. It wasn't just us signing off on what we had here. We went back and forth to look at various renditions. [0:46:52, 0:47:09]: And I think especially the townhouse product and the bungalow product, I don't think we have that anywhere in the city uh at this time right now. And the bungalow product is the one that's gonna be three side brick, is that correct? Yes, there there's example there's an example of one I put on the screen. [0:47:10, 0:47:30]: Okay, so certainly we will go through that and let the applicant make their case for what needs to be done uh here uh as well. But I wanted the public to know that this we sent this back because initially we weren't happy with what came forward and now we're moving forward to try to um work the balance between [0:47:29, 0:47:49]: Between what the neighborhood desires and then the developer. Uh Meritage has built several neighborhoods, the Winding Creek neighborhood, the Winding Creek Townhomes, and the Eagles Hill neighborhoods that are there uh in the area as well. Matter of fact, in twenty seventeen that was the first neighborhood that [0:47:49, 0:48:09]: We as a council uh were able to rezone when I took a when I gain when I came on the council. The road wasn't even there yet. So that was part of the planning. So thank you. No problem. Council, any other questions you have for Mr. Anderson right now? If not, okay then the applicant come forward, name and address and uh [0:48:09, 0:48:12]: Have you pr uh present your presentation? [0:48:12, 0:48:13]: Please. [0:48:28, 0:48:48]: Can I ask a point of clarification before we get started real quick? Sure. Um we're doing them combined, the the three. I mean, in terms of the time allotted to speaking to, you know, we have the land use, the comp plan, and then the zoning, they're combined. They're combined in your presentation, but guarantee we gotta vote on them separately. [0:48:48, 0:49:08]: No doubt, no doubt. I just wanted to be sure in the presentation. I can cover everything. Okay, you cover everything. I'm pretty sure the council have plenty of com may have comments for you. And then of course the public has an opportunity to speak as well. Absolutely. Uh Kenneth Wood 350 Research Board, Peachtree Corners, Georgia. So we're excited about this project, as as uh you actually heard. We've we've first kind of approached this as we started looking. [0:49:08, 0:49:28]: At the area as an all-residential deal. When we first were looking at it, we were thinking on the corner for towns. And then as we actually were able to hear some different comments, we started rethinking about what it what it could be. So what you're going to be proposed with tonight is a mixed use that we think is really well fitting. And we'll talk about exactly how that works. [0:49:28, 0:49:35]: networks, how it fits into the transportation network, how it fits into the surrounding network, and actually how it fits into the site. [0:49:35, 0:49:38]: Um as well. If you're looking at the site here. [0:49:38, 0:49:58]: old campground and are you guys able to see this on the screen? We got it on the So this is this is the northern part and so you have the creek that runs down here on the side. You have campground, the relocated campground that runs through. And there's traffic improvements that have been done as part of that relocation. So we wanted to make particular attention and I'll I'll point this out as I zoom into [0:49:58, 0:50:08]: it about really what we're trying to do, where we're trying to set those access points coming into the property and making sure that we're set up for a successful project for entrance into it. [0:50:09, 0:50:14]: This is the uh proposed zoning for the PUD. As you can see, there's there's quite a few of the PUDs in the area. [0:50:15, 0:50:18]: Um this one also is kind of interesting when you're talking about the comp plan. [0:50:19, 0:50:39]: When we actually first um submitted and started talking about the comp plan change, I was I I was kind of caught off guard that we needed the change because in Henry County it was high density and that we needed to go down down to medium density into into coming into the city. I was I was I was thinking it would it would translate. Um but it it made sense when we looked at our final density that it was [0:50:39, 0:50:59]: Actually fitting into the medium. So that's why we're requesting that as it's coming from Henry is high density. It can't translate as high density because we don't meet those thresholds. So that's the reason that we're here for the comp plan change coming into the mixed-use overlay for the site here. This is the uh parkway of mixed-use overlay that are. [0:50:59, 0:51:10]: here and as you can see as you go up 42 as you head over toward all the way over you going toward Costco that is the theme is when you're up on that frontage what makes the most sense obviously it has additional restrictions. [0:51:11, 0:51:31]: It has a additional quality that is put in there. And so that was the suitability that we wanted to see for the side. And as I just mentioned, this is the medium uh mixed use that is in the area coming over from Henry into here. And then this was our concurrency here, which is basically where we touch uh the city uh at the corner. [0:51:31, 0:51:35]: Let me see if I can I'll kind of start on the top uh for the plan. [0:51:36, 0:51:50]: The total is forty-eight acres. It is divided on the north track and the south track. Uh this is the creek that was spoken about. And so we actually kind of ended, we have additional buffers up here, additional buffers here, but we also have the creek. And so [0:51:50, 0:52:10]: You know, distance from the single family detached homes on the north to the single family detached homes that you would see just off your screen to the north uh east of the site is substantial. You know, you're probably talking about from backyard to backyard, probably 250 to 300 feet, close to a football field in terms of distance from there. Uh we were careful to [0:52:10, 0:52:30]: To make sure we have stormwater management. We know and hearing from a couple of people that we talked to, just make sure we wanted to do good stormwater management so we have the ponds that can accommodate that. And so on this north side, it was very particular about where we wanted to put the access. This is campground that runs here. You have the [0:52:30, 0:52:50]: median that starts here, we have to do as part of what we've looked at from from traffic is left turn lanes and D cell lanes. And so that's the full uh turning movements that have to be installed on our site. And as part of that, we needed to be able to start back here and then that gave us good site distance for installing these so that you can see around [0:52:50, 0:53:10]: Around this bin from the access point and see this way as well. On the north, these are the single family detached that would be here. Those would consist of ranch homes as well as two-story family homes. The other part to this, basically on the east side, there was kind of a little remnant piece, but the topo setup. [0:53:10, 0:53:30]: Well, we had first looked at it as like a small cul-de-sac, but when we got into it, it didn't really make sense to just have kind of three lots kind of orphaned over by themselves on that side. And so we looked at it and thought what it would be a good little medical office, dentist office, something for neighborhood uses uh that could be here at this location. It also set up really [0:53:30, 0:53:34]: well for a circular parking lot and then access coming onto campground. [0:53:35, 0:53:39]: Uh jumping across the road, one thing you'll notice on the on the plans we tried to articulate [0:53:40, 0:53:54]: is all of our frontages, we have the requirement for the multi-use trail as well as a sidewalk internally. And so you'll see that throughout. We have sidewalks throughout the development. We also have the multi-use trail throughout all of the frontages that you're seeing on the plan. [0:53:54, 0:54:14]: And so this is our this is our plan where we cut across from highway 42 over to campground. And so this would be basically a public feeder road here, has some parallel parking off of it. But this road is basically what can feed into the commercial, as well as you have a right in, right out here and here that can feed in here. So it sets up well for. [0:54:14, 0:54:34]: Or basically a grocery anchored, like we mentioned, if it is a large enough anchor, it potentially could have the pumps with it. But we also envision this as having other neighborhood uses where it could be restaurants, it could be office, it could also be different types of retail uses for sale. It's a really good corridor with the [0:54:34, 0:54:54]: The residential uh that is coming in and the quality of it, it sets up really well. It's almost 10 acres of commercial uh that is on this property and sets up, as well as a lot of open space back here. So if this end cap ended up being a restaurant, you could have this outside space if you're waiting or doing things that could have a little bit of a green space. [0:54:54, 0:55:14]: Setting there, uh stormwater management as well. Uh jumping over to the residential. So we really, really thought about this after we got the comments is trying to deliver several different types of product types to the community. Not just one type of product type, but we actually have four. If you think about it, there's four different kinds, and so we have [0:55:14, 0:55:34]: uh attached homes that are here. Uh these can be found. If you if you do want to see this, you can actually drive to Cobb County to what's now the city of Mapleton and see Willow Crest. It's a development over there off Floyd Road. It's really beautiful. Actually my um client here, Meritage Homes, is the developer of that. And this that [0:55:34, 0:55:54]: Was kind of the idea in going to this. So these townhomes are a little wider. When you see the pictures I'll bring up, these are 26 feet wide. So they are several feet, if not four to six feet wider than a lot of the townhomes you'll see. These are the bungalows. And so this is a really unique product. I have not seen this product delivered. [0:55:54, 0:56:14]: By actually any other builder. It's really unique. And there's there's 16 of them. They are rear-loaded, which means if you're driving down 42, you'll see the front of them behind the landscaping. And you would not see the garages. The garages are from the back side. And then if you drive through the rest of the way here, there's two different types of single-family products in here. You can have [0:56:14, 0:56:34]: have if a if a customer wants a ranch home, a one-level home, uh they can offer ranch product as well as the two story uh family homes that you see. Uh we have a large amenity. Uh we're looking at a cabana, a pool, uh uh some type of sport court. We're trying to analyze if if pickleball or bocce or like a pavilion outside grill, what would be [0:56:33, 0:56:53]: The best to be there as part of the marketing, but we set that centrally. So whether you're in the bungalows through here, there's sidewalks around the whole property, it's very centrally located, but also away from the commercial. So there's privacy if you lived in your home in this. All the homes we tried to create basically the wide home. [0:56:53, 0:57:13]: So that we have the public dimensions, even though they're private. So they have all the street trees, the street lights, and everything for it. It is 168. We actually have more detached than we do attached. We have 86 detached and 82 attached homes. The commercial is upwards of 80,000 square feet of commercial. [0:57:13, 0:57:33]: That can fill the space. And it has a great relation to the comp plan when you look at it and just thinking about driving down the street from it. These are some of the homes we were looking at and all the different types of, it's all substantial material that you would see in the homes, as Ryan showed you some. The townhomes out at Willow Crest, more single-family homes. [0:57:33, 0:57:53]: Family detached homes varying of styles, uh, bungalows getting into here, some of the ranch homes with the little front porches, some of the bungalows that have a big front porch and upper front porch. And then here's some pictures actually from Floyd Road, which is a very similar road to Highway 42. It's about the same size and coming down. And so these are some of [0:57:53, 0:58:13]: of the frontages and want to be able to kind of bring these up and and kind of bring two two things uh just to kind of talk about it on the plan. One is um on number number seven, obviously if we can have the ability, if it is a grocery uh anchored to be able to have the the the gas pumps because it's a part of the program. Uh [0:58:13, 0:58:33]: If they do that, if a grocery that large comes. And then on number two, one thing we'd like for you guys to consider. If you saw the elevations at Willowcrest, on the it the condition on number two says uh uh brick on three sides, but what really looks really good is like one house will be brick and then the next one's stone. [0:58:33, 0:58:53]: And so you you'll see that stone. And so we don't want to sometimes if you do all brick, it can get kind of monolithic looking down through there. And so if we can have the ability to have that as has has have that as stone too, and maybe even board board and bat just on the top, 50, that we we'd love to just have the ability because of what some of the how [0:58:53, 0:59:13]: How how great Willow Crest on these came out to be where, see this is a brick, but then this is stone and we were just worried. And then you've got some board and bat with the front porches. And so we just wanted to just ask because we've we've seen what it can look like if you're able to mix it in so that each house has kind of its own identity. And so that would be the only [0:59:13, 0:59:25]: change to the um conditions of staff. If uh you guys could uh think about those that would be fantastic. And with that, I can take any questions or I have uh several members of with Meritage Homes with us. [0:59:25, 0:59:45]: No problem. Appreciate your presentation. I meant to do that right now. I'm pretty sure we'll have some different questions for you. But uh in in my com my thought process is brick versus stone, if you wanna utilize and mix it up some, I'm fine with that. But the council's gotta make decisions. You don't want everything to look the same. And you know, dress right dress. You want to you know, have some tr differ types of traction there. But anyway, they'll let you know. [0:59:45, 1:00:05]: All right. Okay, thank you. Yes, sir. Certainly, I think we had discussed this particular issue. The front, the front facade can be a mix of materials. What we've done in the past is, because all of the townhomes are attached, sure, that we will want the ones um visible from the right. [1:00:05, 1:00:25]: To be brick on the ends so that when someone was coming or passing down 42 or campground, they would see the end unit and the end cap would be brick on the side. But the front facades are flexible. Okay, okay, awesome. We just think it'll look you know good the next time. Right. The ones that Ryan mentioned on the bungalows, however, we're seeing [1:00:25, 1:00:45]: Certainly want to stick with that. That's right there on Campground Road. I mean on uh Highway 42. Certainly that would be the exception and that would be uh three-sides brick on that. You've mentioned already that we have the 10-foot multi-use path, which is along campground road and along highway 42, which will offer us some. [1:00:45, 1:01:05]: Uh, you know, which we don't have any sidewalks there now. Uh it is my hope that the city has$500,000 in T Splos, that we could actually connect those existing neighborhoods, Winding Creek and Winding Creek townhomes, to this development with the T Splos funds that we have. [1:01:05, 1:01:25]: via multi-use trail, which is a 10 foot, so that people could actually leave leave out of Winding Creek or leave out of Winding Creek town homes and not get in their car. They could literally ride their bike or a golf cart or something across there and they would be able to do that. That is the desire uh for the community here, but I'll let my colleagues ask [1:01:25, 1:01:45]: any questions uh that they may and then we also uh had uh imposed that we would have the 30 foot setback um uh for the product uh that is consistent with what we've done with other town home products at all flop cameras at the just our normal our flop cameras at the entrance [1:01:45, 1:01:49]: [3710.2, 3726.6]: I feel like I'm missing something. Street lights will be a c street light as well. Street lights, barrier tree barriers. Um uh to prevent growth of the roots messing up the sidewalks. Um and then [1:02:07, 1:02:22]: Um what am I missing? That's a pretty much the flock camera, the street lights, uh pretty much consistent with that. We got the multi use path in there. Yeah, and now we we require all of our townhomes to have double car garages, correct? Okay. So we're good. [1:02:23, 1:02:25]: So those are of those are identified in the conditions. [1:02:26, 1:02:28]: Come to Mike, please, Ryan. [1:02:31, 1:02:32]: Well this. [1:02:33, 1:02:44]: Planning Commission added two, but they're already in our code, but I read'em in the record just uh they had a condition for uh a ten percent rental cap and a HOA, but that's required by code anyway. [1:02:45, 1:03:03]: Right, that's already uh uh that's some confusion. That's in the code right now. Right. So that's what we would have. They're agreeable to that. That's right, sir. You're agreeable to the rental cap. Okay, sorry. And um the other things that council member gamp uh recommended, that's part of our new uh um design standards too. Oh perfect. [1:03:04, 1:03:15]: All right. And okay, one clarification. The street lights are the metal street lights that we discussed and the the staff would get with them on what they look like, right? The decorative street, metal street room. [1:03:15, 1:03:16]: Yes, sir. Go ahead, Mr. Baird. [1:03:18, 1:03:28]: Okay, metal street lights. You you said we're talking about that's what you you're good with that, sir? Yeah, it's in the ca I've seen I've seen them. They're part of on the committee. [1:03:29, 1:03:32]: I will wait until after the public comments. [1:03:33, 1:03:35]: Okay. [1:03:35, 1:03:42]: Corrector. Yeah, so additionally, when we started, when this was all residential, how many units was there? [1:03:43, 1:04:03]: Uh two hundred and two eighty eight. Two eighty eight. So basically what we did was we transitioned this from two hundred and eighty eight units to the commercial component and now we're down to one sixty eight. So we've reduced the units over one a hundred and about a hundred and twenty, correct? That's correct. [1:04:03, 1:04:16]: And the density here is not high density by our cart Ryan or by our chart. This is medium density. Uh uh on the lower end of the medium density. Yes, yes. This is the lower end of medium density, it makes use residential. [1:04:17, 1:04:37]: Absolutely. So let's be consistent clear and consistent. This is not high density but and folks understand this too. When it was in Henry County, it was high density, right? Yes, it was high density residential. Right. So basically this is down zone to medium versus what it would have been had it been in the county at high density, correct? Yes, I'll mix use. [1:04:37, 1:04:41]: So uh medium density starts at four units per acre and it's right at the bottom of it. [1:04:41, 1:04:43]: Absolutely. All right. Thank you. [1:04:44, 1:04:56]: Any questions, counsel thus far? We're good? All right, on that note I'm gonna open it for public hearing. So I'm gonna start on my very left side. Anybody that f um of comments for forest development. Comments from my very left side. [1:04:58, 1:04:59]: In the middle, in the common floor. [1:05:00, 1:05:01]: My very right side. Comments four. [1:05:02, 1:05:06]: All right, so I remember my very left comments against uh against this particular development. [1:05:07, 1:05:16]: All right, in the middle and comments against. This line up on that side with comments against. My very right, and comments against. Okay. Please sir, come to the mic and uh your name and address. [1:05:17, 1:05:34]: Yes, uh good afternoon. My name is Willie Carter, uh 123 Wilson Avenue. Um the the problem without a lot of these projects y'all be presenting, to s y'all do a lot of substantiating to other counties. And and what I mean by that, you're not comparing apples to apples, you're comparing apples to oranges. [1:05:34, 1:05:43]: True enough, Cobb do does do that. For my I'd be privy to it by being contractor work, with I see what they do, they don't do any development unless the infrastructure is there. [1:05:44, 1:05:48]: If the infrastructure's not supporting what you're trying to plan to present. [1:05:48, 1:05:49]: They don't do it. [1:05:50, 1:06:07]: So again, I I don't know I don't understand why y'all presenting all these new developments when the infrastructure is not there. Flipping doesn't have the inf infrastructure. 138 Tojotico doesn't have the infrastructure. So again, if the infrastructure is not there, why you keep presenting these new developments? [1:06:07, 1:06:10]: Thank you. Yes, ma'am. [1:06:12, 1:06:13]: Name and address, please. [1:06:18, 1:06:38]: Um Jocelyn Williams, one ninety Banks Drive, Stockbridge, Georgia, three oh two eight one. Am I doing opposition to annexation? Compensate altogether? Yeah, if you've got any comments on annexation, comprehension plan, rezoning case. If you have comments on all those, they're fine. No comments against that, I guess. Uh comments against annexation, company comprehension. [1:06:38, 1:06:58]: Comprehensive and rezoning. My concern is Birch Creek Elementary is a brand new school, first one in Henry County in 10 years, and it's already overcrowded. It opened in August. My concern is once again for the schools, the 168 homes that [1:06:58, 1:07:18]: That will come on a two-lane road of um Fort Highway 42. Um, that would be my concern that the mixed-use specific uh I'm gonna use um caliber car wash. I called last year and asked what would be built. They said a car wash and it had room for other things, but they didn't tell me specifically. [1:07:18, 1:07:38]: Specifically, what it is. In 2025, I now know it's caliber car wash, small hamburgers, and it's um urgent care. So I was just concerned about the mixed use, the needs, and the specific things that will be built all into the comprehensive plan amendment, um, and the annexation, everything is thrown. [1:07:37, 1:07:54]: in but as I watch trying to make sure I get copies of everything so I can keep up with the excellent job that everyone is doing, I just have to do opposition because I need the infrastructure, the schools and the traffic to be included. And I thank all of you so very much. [1:07:54, 1:07:57]: Thank you. Ryan, could you come back to the point, please? [1:08:00, 1:08:04]: We're assuming that you layer two did you five. [1:08:05, 1:08:07]: Who s oh this gentleman? [1:08:07, 1:08:10]: For against. Now did you ask if they were against on this side? [1:08:12, 1:08:22]: Well yeah he did all he Oh okay I'll you did all three already. We're uh we're gonna uh we're gonna vote on individually. Infrastructure. I don't know if can you answer in reference to infrastructure data can [1:08:22, 1:08:41]: As it relates to traffic, uh the city of Stockbridge is is for it can't uh can't use traffic as a determining factor in approving or disapproving rezonings. There are only two uh places in the state of Georgia right now, and that's Gwinnett and the City of Atlanta metro area that can use traffic as a um [1:08:41, 1:08:51]: as a criteria to deny rezonings or zoning actions. But Stockbridge is not one of the areas that can do that. So when we do our zoning analysis, we don't we can't really take traffic into consideration. [1:08:52, 1:09:09]: North schools. Okay. North North Schools, yes, that's correct. Right. That was gonna get there next with North Schools and the mixed use development. I guess uh we've already I guess uh applicant already talked about all the different types of things potentially scheduled to come or or to be there to mix use part of that process besides the living quarters and businesses. [1:09:10, 1:09:11]: Can you expound on it at all? [1:09:11, 1:09:30]: Um we don't they haven't exactly determined what type of businesses will come, but um they want to anchor their re their uh the retail component of this with a grocery store. Okay. So and they will have eight thousand square feet of office space and they will have um um [1:09:30, 1:09:47]: I'm not sure the exact breakdown of the retail, but it's like seventy two thousand square feet of retail altogether. So, um they will have several restaurants, um maybe sit down restaurants. And um but they haven't they haven't decided what type of business is the name of the businesses that will come yet. Okay. [1:09:47, 1:09:55]: Can can the applicant come back up and maybe spound on it just just uh uh you get a chance, sir. Just to kinda spound on that possibly. Just to make sure. [1:09:59, 1:10:19]: So as uh as the as the project starts to build out, what we have envisioned is that this here uh would be um would be office most likely because it's more s tucked into the neighborhood. Okay. It has good parking, so more, you know, dentist office, medical office, uh law office, uh something that you would [1:10:19, 1:10:26]: you know, it expect kind of in a in a kind of going back into the suburban area uh that would be there. Uh up here, um [1:10:27, 1:10:47]: We showed a grocery this is a little bit of a smaller grocery. Uh this could end up being a larger grocery and just one out, you know, just one out part. It could be because if you we one of the larger groceries which uh they are um looking at right now, it would take up m you know most of the site and it would be a new grocery with some retail beside it and and mostly [1:10:47, 1:11:07]: Uh but the under this scenario right here, uh this was we were looking at like a lethal Aldi size uh grocery uh that would have different type of shops here, as well as uh restaurants and potential that this could be like a little outparcel over here, uh, but everything would be neighborhood scale. You know, there's no automotive, there's no, you know, as as conditions. [1:11:07, 1:11:23]: nail shops, any any of that, pawn shops. Uh this is all neighborhood scale retail. And so, you know, if if approved, we'd immediately start moving toward that that, you know, moving toward finding what those retailers are and seeing if the grocery was going to grow to the bigger grocery or be more of the boutique size. All right. [1:11:24, 1:11:28]: Council, any other questions that you want to ask the gentleman here? Real quick, Ryan, come back to the point of [1:11:29, 1:11:30]: Mm-hmm. [1:11:33, 1:11:53]: As a part of this development, this council has endeavored in this area is in the highway corridor. Yes, sir. Parkway mixed use overlay. And this council has established very high standards for what the parkway corridor is, right? Yes sir. Can't have any truck stops there, can't have any warehouses there, can't have [1:11:53, 1:12:10]: have any um vape shops and that kind of thing with the distance restrictions and all of that. Yes. Is that correct? Yes sir. So certainly we have already prescribed what we don't want at this particular location. And I think uh we were going to add car washes too, right? [1:12:10, 1:12:13]: Uh car washes are already prohibited. [1:12:13, 1:12:33]: Core washes are we did add it. Okay. So sir, so we understand that everything that you guys have told us, we've added restrictions on that. Matter of fact, we're one of the only communities in Henry County to have those restrictions on various businesses with distances, mileage restrictions. So the the applicant has [1:12:33, 1:12:48]: been amenable to that and has agreed to abide by what those court highway corridors plan standards were. So and understand the last thing I want to say is understand this ladies and gentlemen is that something is going to go at this location. [1:12:48, 1:12:56]: And that's kind of where we are right now. Something is going to be built here. And what we do is Georgia is a property rights state. [1:12:57, 1:13:17]: People can sell their land to different developers. Just like they sold this particular piece of land to this developer, they could have sold it to somebody that we had to fight in court to fight off a warehouse or fight off something that we did not approve of. So sometimes what you do, and I'll repoint back and I'll close by saying this. [1:13:17, 1:13:37]: Winding Creek, the neighborhood that's on Campground Road now, had an industrial zoning, which means a warehouse could have been built on that Winding Creek property under the old industrial zoning. So we took the neighborhood in order to change the zoning to mixed use to prevent an unwanted. [1:13:37, 1:13:57]: Use from being located there. So sometimes just playing chess over here, then playing checkers and understanding what we got there is represents quality and that's kind of where we are now. Thank you. Thank you. Okay, and on that note the public hearing portion for public comments is ended that, but we'll continue still a public hearing, but that portion has been closed since the [1:13:57, 1:13:58]: [4439.4, 4450.0]: So what I have now is uh annexation case AX dash 2024-02 for 1778 and 7 uh 1872 Highway 42 North. [1:14:10, 1:14:30]: Council District 5. Consideration of an annexation request of the two parcels at 1778, 1872, Highway 42 North to allow for construction of the mixed-use development, which would contain single-family detached homes, townhomes, bungalows, and commercial uses. Owner, Rowan Properties, LP, applicant, Meritage Home CO, Clay. [1:14:30, 1:14:45]: Kirkley, Agent Haley Todd, PEC. Properties located in Landlot thirty five district seven, contains forty eight point five nine acres. Uh council, I need a motion to approve this uh development. So moved. Is there a second? [1:14:46, 1:14:50]: I second. All right. From Miss Razaner to Miss uh [1:14:51, 1:14:53]: Can't. Yes. [1:14:55, 1:14:56]: Yeah, I'm taking an order, yes. [1:14:58, 1:15:05]: Yeah, since Okay, I'm I'm I'm in taking it in order. All right, so motion was made in the second long favorite, please indicate. [1:15:07, 1:15:10]: Okay. Posey. [1:15:10, 1:15:24]: This is a yes, sir. That's this is the only answer. Yes, sir. You approve. Okay, so that's the unanimous decision. All right. Thank you, Council. Uh comprehensive plan amendment case CP two zero two four-zero nine for seventeen seventy-eight. [1:15:25, 1:15:28]: eighteen seventy two highway forty two north. Once again council district five. [1:15:29, 1:15:44]: Consideration the Comprehensive Plan Amendment request to assign to future land use designation a medium density mixed use to two parcels at seventeen seventy eight, eighteen seventy two Highway forty two North, after their annexations in the city of Stockbridge from an unincorporated Henry County. [1:15:44, 1:15:53]: To allow for the construction of the mixed residential development, which would contain single-family detached homes, townhomes, bungalows, and commercial uses. [1:15:53, 1:16:13]: Owner Rowan Properties LP, applicant marriages home, CEO Clay Kirkley, uh Agent Haley Todd, PEC, properties located in Landlock Thirty Five, District Seven, contains forty eight point five nine acres. Council need a motion to approve this plan. Ryan, one question real quick for Ryan. I just want you to go on the record again. [1:16:13, 1:16:33]: This particular zoning before the annexation was at high density in Henry County, correct? Yes, the land use was high density residential, yes. Right. So basically they came to us to down zone this to medium under our standard. That's what we're doing. We're changing it from high density Henry County down to medium density stock bridge. [1:16:33, 1:16:35]: Yes sir. [1:16:35, 1:16:36]: Is there a second? [1:16:37, 1:16:46]: Mr Holly smokes. Berry. Berry. I'm sorry. Got a mental minimum lapse there. Mr. Berry, second now. All in favor, please indicate. [1:16:47, 1:16:49]: Mayor I have a comment. [1:16:49, 1:16:52]: Okay and you pose? One second. You oppose or sustain, Miss Barber? [1:16:53, 1:17:04]: I abstain. Okay, three zero one motion passed. What's your comment, ma'am? Uh I just wanted to notify those who are concerned that um [1:17:05, 1:17:08]: Some of the reasons we do what we do now. The roads are wider. [1:17:08, 1:17:22]: So that, you know, when we d we've dealt with parking on the street in the past, we've dealt with different things and so in those subdivisions and those planned communities now, the roads are wider, our sidewalks are wider, they're no longer [1:17:22, 1:17:35]: Sidewalks there trails enough to you know not just walk but ride bikes and and and uh pathways that we're connecting. So we are thinking about the infrastructure as we go. [1:17:36, 1:17:43]: based off of what we have to deal with. And um and I just think a lot of times we don't [1:17:45, 1:18:00]: emphasize it enough, but we can't a lot of times we can't control stores. And a lot of times we can't tell you what stores are gonna be here. There are a lot of non-disclosures, right? They don't want you to know. We can't, and that's part that's all a part of economic development. However [1:18:01, 1:18:09]: Like Councilman Um Alexander had mentioned, we've done everything in our power to make sure that we restrict [1:18:09, 1:18:14]: certain stores from being in close proximity to each other so that we don't have [1:18:14, 1:18:15]: What [1:18:15, 1:18:19]: You know, five or three or two of the same stores right beside each other. [1:18:19, 1:18:24]: So we've done I think we're doing a great job at that now, but we are planning our developments. [1:18:25, 1:18:29]: Um for higher standards in regards to [1:18:30, 1:18:33]: the types of products, stone and brick and you name it. [1:18:33, 1:18:47]: And the width of the roads as well as the width of the sidewalks. So we consider all of those things. And you gotta think about it. When you have those things, sometimes the prices are increasing, but not only that, what store is gonna go there? [1:18:48, 1:18:53]: Right. And so we have that commercial component, you know. [1:18:53, 1:19:04]: uh they've gotta match that area. And so I just wanted you guys to get ahead, you know, kinda get a better um understanding of what that looks like. [1:19:04, 1:19:23]: Yes, sir. Go ahead, please. So sorry that you didn't acknowledge me. I didn't see you, but go ahead with your comments. Go ahead with your comments. Mr. Anderson. Go ahead with your comments. Mr. Anderson, the conditions, are they um tied to the comprehensive plan or the rezoning? Uh they're tied to the rezoning. [1:19:23, 1:19:26]: Okay. I'll hold my questions until then. Thank you. All right. [1:19:26, 1:19:35]: Mr. Alzheimer's go ahead, please. Yeah, thanks. I appreciate it. Uh certainly we want to make sure that we're doing everything and so the public is aware. [1:19:35, 1:19:41]: This council did everything possible in order to get infrastructure and road dollars to Henry County. [1:19:41, 1:20:01]: Two billion dollars is coming to Henry County. Mayor, you remember we went to the uh the town hall or the charrette for Highway 42, because it's gonna be widened from McDonough all the way to Stockbridge. And we showed up and we said, we want that 10-foot path on one side and five-foot sidewalk on the other side, just like y'all do. [1:20:01, 1:20:09]: Do on the north side. It's going to take a while. And the history of this is the people that had these seats 20 years ago. [1:20:10, 1:20:30]: They could have gotten transportation dollars for you, but they didn't want the community to grow and they tried to stand in the way of it. As a matter of fact, they teed off GDOT so that we wouldn't get dollars to come to the community. This previous uh administration, along with chairwoman Carlotta Hurrel in Henry County, has secured two billion dollars. [1:20:30, 1:20:50]: To widen almost every road around here. But because of what happened in the past, all of our projects are at the bottom of the list. Now, the project that you're seeing from Hudson Bridge Road onto Jonesboro Road is now underway. That project was approved first in 2018 and is just now getting underway. [1:20:50, 1:21:10]: But it'll provide four-lane highway from Hudson Bridge Road to Jodico through the middle of the mixed-use development down to Jonesboro Road. Highway 42 is going to be widened from McDonough to Startbridge, but it's going to be in the year 2030. So it's going to be a while because we just secured those funds. [1:21:10, 1:21:24]: when we got on when we got in into office. So it takes seven to eight years before anything else would happen after that. We're doing everything that we can to get these transportation dollars here as quickly as possible. [1:21:24, 1:21:35]: Matter of fact, got a phone call tomorrow with uh Congressman Osau or Senator Ossoff's office about trying to get some paving dollars for uh Eagles Landing Parkway. [1:21:35, 1:21:55]: Tomorrow, that's right, because we're doing everything that we can to assist and to move forward with transportation dollars uh for the community. But please understand this highway is going to be wide and it's going to take time. But in this plan here, the developer they're gonna have to add deceleration lanes and acceleration. [1:21:55, 1:22:06]: acceleration lanes as traffic improvements to this area so that folks don't have to slow down, they can get into the the the D sell lane and they can turn into the neighborhood. Is that correct? [1:22:07, 1:22:27]: Yes, that's correct. And when they're leaving the neighborhood, they don't have to pull right out into busy Highway 42. They'll have an acceleration lane there. And for correction, Highway 42 is three lanes in this area, not two. And this is what's coming, but it's going to take a while because we have like I said, we've done everything that we could to [1:22:27, 1:22:32]: to move forward, but certainly understanding is there gonna be some patience. [1:22:32, 1:22:38]: As a matter of fact, Highway forty two is being widened right now from the Walmart [1:22:38, 1:22:58]: Highway six to I-675 exit two uh in a fifty million dollar project. Rock Quarry Road will start widening as well later on this year. We'll start having Rock Quarry Road widening. So many things are coming to us. Many things are coming. So let's be patient and understanding that things. [1:22:58, 1:22:59]: Things are happening here. [1:23:00, 1:23:20]: Thank you. All right. Okay, we'll move on. Rezoning case RZ-2024-10 for two parcels at 1778 and 1872 Highway 42 North. Once again, Council District 5. Consideration of rezoning request to assign the zoning districts of PUD plan uh [1:23:20, 1:23:29]: Development and PMU Parkway mixed use overlay district of two parcels of 1778 and 1872. [1:23:30, 1:23:45]: Highway 42 North after their annexation into the city of Stockbridge from unincorporated Henry County to allow for construction of missed mixed residential development, which would contain single family detached homes, townhomes, bungalows, and commercial uses. [1:23:45, 1:23:58]: Owner Rowan Properties LP Applicant Meritage Home CO Clay Kirkley Agent Haley Todd PEC. The property is located landlock thirty-five in district seven and contains forty eight point five nine acres. Okay. [1:24:02, 1:24:06]: Need a motion to approve this uh to vote this rezoning case. Yeah. [1:24:06, 1:24:07]: Yes, ma'am. [1:24:08, 1:24:09]: Yes. [1:24:10, 1:24:20]: My number um the applicant, Mr. Wood, mentioned number seven and a grocer. Was that clarified? Um number seven. Seven on the [1:24:22, 1:24:24]: Come come to the mic, please, sir, so we can hear you. [1:24:24, 1:24:26]: It it's conditioned on the site plan. [1:24:30, 1:24:39]: I know there was a lot of discussion on it, but I wasn't sure what the how the final condition would read. If it said if it's a grocery anchored center, it is allowed to have pumps or [1:24:40, 1:24:46]: Yeah, we got we got a we got um legislation coming up after this to address some of those. [1:24:47, 1:24:52]: Well this would uh it'll be more than this. [1:24:53, 1:25:13]: [5113.2, 5113.6]: Yeah. [1:25:13, 1:25:16]: Well the preponderance of their um [1:25:18, 1:25:38]: In their their revenue would be driven from other products other than the gasoline station like the Costco. Right. And the staff would draft and legal would draft the the appropriate language. How would how would that how do you have any idea how you verb the verbiage uh just the legal idea how the verbiage would be? Um we'll we'll say um d that [1:25:38, 1:25:53]: that we'll identify that parcel on the site plan and say that it should be a grocery store and uh that the major portion of its sale it can have a gas pump if the if the majority of its sales come from other items beside gasoline sales. [1:25:54, 1:25:56]: Well just like something like that. [1:25:57, 1:26:03]: All right. You you have that I do have another one he got. Go write it, please. [1:26:04, 1:26:07]: You had another one? Yes, uh uh number two. [1:26:10, 1:26:14]: of Hasley Alexander mentioned the right of way lives. [1:26:18, 1:26:20]: You had that anyway. [1:26:21, 1:26:25]: The inn units of the town homes will be brick facing the public uh view. [1:26:29, 1:26:32]: We can send you the notes tomorrow. Go Gordon's taking notes too. [1:26:41, 1:26:41]: Yes, ma'am. [1:26:47, 1:26:48]: Yes, ma'am. Mm-hmm. [1:26:49, 1:27:00]: And we need to strike that one about the barbershop, all of that. We've already discussed that. Uh it's under the highway park co corps. Yeah, they'll be banned. So you're saying Yeah. [1:27:02, 1:27:07]: Ms. Barber has a question, Mayor. Uh no, go ahead, please. Ms. Barber, do you have a question? [1:27:08, 1:27:19]: I have a series of questions. Thank you, Mayor, for acknowledging me. You're welcome. Um so Mr. Anderson, can you tell me how many entry and exit points are there [1:27:20, 1:27:22]: On to Campground Road. [1:27:23, 1:27:24]: Um [1:27:25, 1:27:26]: One. [1:27:30, 1:27:32]: Cause I'm looking up at the very top. [1:27:33, 1:27:38]: I see uh I see when is that correct? Four oh, it's four. Four. [1:27:38, 1:27:47]: Que them out to me. Because I only see two. It's four. That's the main one. One two. [1:27:47, 1:27:57]: Only specifically to Campground Road. Sure. So Campground has a limited that means right in, right out, to get into the retail faster so you clear the lane. [1:27:58, 1:28:10]: Uh it has one coming into the primary, uh, retail and residential here as well as this side. That's three and the one, two, three. And then over here on the little office it has its own little entry. So that's four. [1:28:11, 1:28:27]: Thank you. Yeah. How about highway forty two? I just want to make sure I'm looking at this right now. It does too. It has a limited right in, right out, uh so you can get in faster just as you're coming for the intersection that has the main entrance, so two on uh on highway forty two. [1:28:27, 1:28:29]: Thank you, sir. You're welcome. [1:28:30, 1:28:32]: Um okay, so let's see. [1:28:34, 1:28:43]: The ten feet walking trails, those are are automatically included, correct? Yes, by code on the furniture. Yes. Okay. Um [1:28:45, 1:28:47]: I don't see any mention of a clubhouse. [1:28:47, 1:29:00]: Glovehouse. Mm-hmm. Is that not something that they would be amenable to? Yes, we we we need to. That's a question that I'm asking Mr. Aaron. Yes. I'll let I'll let the applicant answer. [1:29:02, 1:29:10]: Uh so yeah, w the term we refer to in the application is a cabana so that it has like an outside area as well as bathrooms, but it goes with the pool. [1:29:10, 1:29:19]: And so we have a we'll have a cabana in a pool and then we're looking at sport courts or bocce, anything like that. Okay. And how many people will that cabana hold? [1:29:19, 1:29:24]: So the uh in terms of inside of it? Mm-hmm. Oh, I don't even know. [1:29:27, 1:29:28]: Approximately. [1:29:29, 1:29:49]: I d I don't know. It's probably I mean, if you have uh, you know, the typical pool day, you have thirty people at the pool, maybe five people go in there. I don't know, seven. I I know they're not it's not giGanttic. It's not made to like is a like a more of you see on the age restricted where they're you kind of s setting it up for like bingo and tables and stuff. It's more of it's more of [1:29:49, 1:30:09]: Be able to have a place to get out of the sun, relax, have a drink, and go to the bathroom, everything like that. The reason why I'm asking is because I know that there are oftentimes these communities want to host like you know, their HOA meetings or birthday parties or receptions, those kinds of things. And just having a clubhouse. [1:30:09, 1:30:14]: house specific to their subdivision just gives them, you know, the availability for them to [1:30:14, 1:30:22]: You know, do it right in their community. That's why I'm asking. I gotcha. I gotcha. That's all. That's not something that you all would be amenable to. [1:30:24, 1:30:25]: Just asking. [1:30:26, 1:30:27]: Yes. [1:30:30, 1:30:50]: It it it sounds like I know I know personally usually it's over two hundred when they do the giant uh uh clubhouses. I I would think that's not what we were trying to go for here because we're you know, we have so many trails and the retail are trying to get everybody out there. And so I think the vision of this would be if they had those meetings, they would either have them outside. [1:30:50, 1:30:53]: [5453.9, 5455.5]: Okay. Well I [1:30:55, 1:31:00]: I a actually support having clubhouses and a pool. [1:31:00, 1:31:08]: in each of our subdivisions, but nonetheless, um that's something that I will consider when I make a decision on this. Um let's see. [1:31:10, 1:31:17]: And I see that you have the connectivity between the different housing types. Thank you. Thank you for that. Um [1:31:19, 1:31:32]: The front and side yard setbacks, Mr. Anderson. I'm sorry, sir. I know that the council approved um updates to our codes. Did we change the front yard setbacks to fifteen feet? [1:31:33, 1:31:45]: Um no it that w that was pertaining to the MFR uh district, to multi uh multifamily residential district. That that's the one that we addressed in our recent legislation, not not PUD. [1:31:45, 1:31:49]: Thank you, sir. So under the PUD, the front yard sit back. [1:31:49, 1:32:03]: The p PUD is site plan specific is whatever um the applicant proposed and proposed and if counsel accepts it and then it will be then it will be um conditioned on that site plan. Okay. So can you tell me for this particular proposal? [1:32:04, 1:32:07]: What is the front yard setback that they are proposing? [1:32:07, 1:32:08]: Uh [1:32:09, 1:32:14]: W when you include the um the sidewalks and the right of way, uh it's it exceeds thirty feet. [1:32:15, 1:32:21]: Thirty feet. Mm-hmm. Okay. And that's what we that's and that's what we specified in our MFR district. [1:32:21, 1:32:24]: Thank you, sir. What about the um side yard setbacks? [1:32:24, 1:32:44]: Um the side yard setbacks uh it usually applies to the S R R district and in the MF M F R district it replies to the building. So it's like twenty feet between each building. So but like I said, PUD is site plan specific, it's like custom. You customize your [1:32:44, 1:33:04]: your setbacks and things and council votes to approve or disapprove. Okay, so for this PUD, well, I'll let him tell me then since he's so it depends, you know, which house is chosen on the lot. Um if it's the biggest one, they could be, you know, 12 feet apart and then they can go up to being 15, 16 feet apart. [1:33:04, 1:33:16]: you know, lot to lot, just depending on the house,'cause, you know, some houses are forty feet wide, some of'em are thirty six feet like a ranch. So it it there's some variation there. Okay. For the custom builds. I get it. [1:33:16, 1:33:18]: I gotcha. Okay. [1:33:18, 1:33:19]: Um, let me see. [1:33:20, 1:33:23]: So I don't really like the [1:33:25, 1:33:45]: short or close um units or houses. So I like to see distance in between the units, whether they are single family homes or town homes. That's all. That's just what I prefer. I gotcha. Are you amenable to reduce the density [1:33:45, 1:33:52]: the town homes so that way you can make room for clubhouse or is there an area [1:33:52, 1:34:12]: They they don't have I mean, honestly, we when we did this plan when we when we reduced the hundred and twenty-one units, we kind of put and then we further reduced it with the cabana, you know, with the uh um bungalows. That I they pretty much kind of got to the like their best foot forward. This plan, we looked at the engineering on it, we knew we could execute. [1:34:12, 1:34:20]: Execute it. So this this is the plan we're we need and propose. Because uh honestly, and on and to kind of address some of those comments is [1:34:20, 1:34:40]: If an if an hoa isn't enough in years to come, they they really can struggle and fail. Like if there's too much to maintain, the pool's too giGanttic, it has too much on it, the clubhouse is too big, and it starts going down in 20 years, those those HOAs bec can become a problem. So we we know we can make a very successful subdivision. [1:34:40, 1:34:46]: and what you see today. And that's why we wanted to be transparent in with what we're putting forward, we can execute a high quality development. [1:34:46, 1:34:47]: Thank you, sir. [1:34:47, 1:34:49]: Um let's see. [1:34:50, 1:34:58]: Price points. Can you tell me what the price points are that you kind of can guesstimate for the townhomes? [1:34:59, 1:35:15]: Sure. I mean, I I think all of them are gonna be what we've kind of talked about is uh mid threes up to into the fours and then the single family and bungs bungalows are gonna be fours and up into the fives for dislocation. Probably even sixes as they get bigger. [1:35:16, 1:35:18]: So for the town homes you said mid four hundreds? [1:35:19, 1:35:22]: Mid threes, up into the four hundreds, mid fours. [1:35:22, 1:35:25]: That's a four. Okay, and the single family you said [1:35:26, 1:35:40]: They're gonna be into the low low four hundreds and they're gonna go into the fives and even to the six depending on basement and options and you can option it up. Uh everything is market depending. And so if if everything starts immediately selling, I mean they could get up [1:35:40, 1:35:41]: Extremely high. [1:35:42, 1:35:45]: Okay, thank you. Um the square footage. [1:35:46, 1:35:47]: For the town homes. [1:35:52, 1:35:52]: Oh. [1:35:54, 1:35:57]: So on the town homes [1:35:59, 1:36:10]: They range from the the smallest pack the smallest one could be seventeen thirty six and then they go all the way up to tw two thousand one hundred and sixty five. [1:36:12, 1:36:16]: Okay. Thank you for that. What about the single family homes? [1:36:17, 1:36:37]: The single family range from uh 2400 to just under 3300, and then with basements can go up to four. And the ranch homes are uh 1800 to uh right at 2,000 square feet. That would be a one level. So there's two types. The big ones are the big ones obviously. [1:36:37, 1:36:40]: Those are the b way bigger uh two story. [1:36:40, 1:36:46]: And tell me um for the bungalows you said the square foot? Those go up to twenty four forty three. [1:36:52, 1:36:56]: Okay. Thank you, sir. I appreciate that. You're welcome. That's all I have. [1:36:57, 1:37:00]: Mayor. Yes, sir. Go ahead, please. Sir, don't don't leave. [1:37:01, 1:37:21]: Certainly, I think um we had talked about the clubhouse and I think we I don't know how that kind of but there's going to be a clubhouse. So we did one similar down at Winding Creek that will hold about forty or fifty people and certainly something appropriate to that level because Winding Creek has maybe like a hundred [1:37:21, 1:37:41]: hundred and I think they got like 107, 120 houses in there, but certainly on the many zooms that we had, we certainly talked and discussed about having a clubhouse. I think you said that about the cabana, but I think I really emphasize that we wanted to have a clubhouse that's mandatory on every subdivision. [1:37:41, 1:38:01]: that we do that's over a hundred units. So this is kind of where we are on that. But we're not asking you to do a clubhouse that holds 500 people, but certainly appropriate for what we do, something about 40 to 50 people. And that would be equivalent to what you did in a little larger maybe than what you did in Winding Creek, which has [1:38:00, 1:38:18]: a hundred homes. This one has 168, but something in there between 40 and 50 people. I I like to have my town halls over there. So I've had several town halls over there and they have a nice little setup with the pool there and they have uh for they have town halls there. Gotcha. Okay. [1:38:18, 1:38:34]: I've no the comments, uh I've already read I do, Mayor Ford. Yes, ma'am. Considering what Councilman Alexander just mentioned, if he's going to build a clubhouse, will that require you to decrease the amount of units that you have? [1:38:34, 1:38:35]: No. [1:38:36, 1:38:39]: No? No. Okay, so where would the clubhouse go? [1:38:39, 1:38:43]: Maybe what it opposed. I mean it where you where you see it. [1:38:44, 1:38:46]: For the cabana? Mm-hmm. [1:38:46, 1:38:47]: Okay. [1:38:48, 1:39:02]: Um it's an area it's an area larger than that. Um, you know, maybe another four hundred, five hundred square feet of green space gets taken up, but it'll still fit in there if we need it to fit. We're just trying to avoid the additional HOA fee part of it. [1:39:03, 1:39:05]: Okay. Um [1:39:05, 1:39:07]: But would you have the parking space? [1:39:08, 1:39:14]: To accommodate a larger clubhouse. Oh yeah. Okay. That's why I'm asking if you would be able to re [1:39:14, 1:39:16]: If you would have to reduce the density. [1:39:17, 1:39:18]: Thank you, sir. [1:39:21, 1:39:41]: Okay, I need a motion to approve, please. Mayor, based on the what we've just discussed, certainly we will have a that add that to the conditions, a clubhouse of the comp staff will work through that, uh forty to fifty people capacity, something similar to what we had up at the Winding Creek subdivision, uh that would be appropriate. Uh [1:39:41, 1:40:01]: For that, let's add that condition uh in there. We got the pool already um uh in there uh as well. All of these conditions uh that are listed, the metal uh street lights uh that were listed, the flock cameras that were listed. Uh Miss Holliday, will you read back the conditions? [1:40:06, 1:40:15]: So other than the staff conditions, they're gonna change to number two with the townhomes having the [1:40:15, 1:40:29]: brick on the sides that are facing the public. And then on number seven, um staff is going to create language that identifies what the grocery store would be like. [1:40:30, 1:40:33]: Number nine has ten percent rental cap. [1:40:34, 1:40:39]: Number 10 is an HOA and number eleven is a clubhouse. [1:40:39, 1:40:43]: Um now as I understand it there's the street polls are in the code. [1:40:44, 1:40:55]: But the type of street polls are going to come from staff having conversation with the developer and also flock cameras are already in the code as I understand it. [1:40:55, 1:41:15]: Yes, in addition to that, they would need to be black and metal. Any crosswalks or signalization would need to be metal and black uh as well uh on list. And and even though it's in the code, I want to make sure that we have the ten foot multi-use pass alongs all all [1:41:15, 1:41:35]: All ALL of the frontage along Campground Road and the Highway 42 of this particular property. So I understand the Tabernacle of Praise is going through a very large renovation for their church. So certainly it might be nice if those residents could just walk down to [1:41:35, 1:41:55]: the tabernacle of praise uh along that path because part of that requirement I'm sure in the Henry County standard is that would have they would have to put a 10-foot multi-use path along this corridor uh as well. So certainly this is something that um would be amenable and um to what we had and then again we [1:41:55, 1:42:05]: we talked about the conditions along the highway uh corridor would be the requirement here in the grocery and based upon that mayor uh so moved [1:42:05, 1:42:09]: I wanna make sure that the applicant all those conditions we talked about, you're all good with those, correct? [1:42:10, 1:42:11]: Okay. As you nod your head, yes. All right. [1:42:12, 1:42:14]: Oh, motions are made and is there a second? [1:42:15, 1:42:23]: Mr. Berry second then. You got it right there, Tom. All right. All favor, please indicate. All pose. Sustain. [1:42:23, 1:42:38]: I will abstain. I have concerns about the density and I support the annexation. I just have concerns about um planning for all this growth. That's all. Three zero one, the motion passed. Congratulations, gentlemen. All right. [1:42:40, 1:43:00]: All right, what we got next, uh Text Amendment case TX uh 2024-06 for the gas station distance requirements citywide. Consideration of ordinance in the text amendment to amend Title 12 Unified Development Code, Chapter 3, Use Regulation, Section 3.2.14 C. [1:43:00, 1:43:20]: to add sections 3.2 point one four E F G H I I J K L N N O P. I get the whole alphabet here, okay? Relating to the gas uh gasoline service stations so as to amend the gas station distance requirement four thousand feet to eight hundred feet. [1:43:20, 1:43:40]: And to add additional requirements providing uh to provide the serve uh servability, severability to the repeal uh conflicting ordinances to provide an affected date and for other purposes. Mr. Ryan, please. Can I ask a question, Mayor, before we get started? Yes, sir. Mr. Anderson, I I this right here, okay. [1:43:40, 1:43:58]: So the uh the approach, I trying to understand the approach and then hopefully you'll explain what it is. Wouldn't it just be might be a I don't know what this approach is that that that they were bringing to council for a approval to get this variance whether then [1:43:58, 1:44:18]: Councilman Malizella, we don't have a provision in the code for that. So that's what we're trying to uh implement. We're trying to anything that we do, we can put that caveat on there that they would have to come back council. Oh, that's that's definitely yeah. They would need a special use permit. We're reducing it and replacing it with a special use permit required. Okay, so this is a special use permit. Yeah, so that's all we're doing. We're asking the re because we have [1:44:18, 1:44:32]: have several um um potential mixed use developments uh that we're working on. Um and currently they so all we're asking is that the applicant, the developer be able to bring his bring his proposal to council. [1:44:33, 1:44:53]: So council can decide based on the individual merits of the project. So currently they can't even come before council to ask for that reduction because there's no provision in the code. So we're just asking you to reduce it from forty five hundred to eight hundred feet with a special use permit by council. So council still will control the entire process. Well, this would be like something uh [1:44:53, 1:45:13]: And then we had Costco on the other side there that might be a little bit close. That's what you're trying to accomplish here? Yes, sir. Similar to that. But what would allow Costco's was [1:45:13, 1:45:33]: Was that it was governed by the Bridges of Johto Coast South Master Plan, and that master plan trumps our zoning ordinance. But citywide, there's no provision for this. So which but that's what I'm saying. It's the same concept, which is without that development agreement, they wouldn't have been able to do that. Exactly. But in the future, if there was somebody who wanted to do something like this development. [1:45:33, 1:45:53]: development right here and there is there was a gas station right down the street, then this Publix or this or Kroger or whatever would be able to do that. Yes, sir. Like the analogy you gave earlier when you mentioned Kroger, like it would be like a potential Kroger with pumps. That would be part of the development that we recent we just heard. So currently [1:45:53, 1:46:07]: they wouldn't be able to come before you with that proposal with the current regulations in place. If we amend it, then they could come before council and ask for a special use permit. And council has the right to deny or approve. [1:46:07, 1:46:19]: Yeah, uh you go ahead with your whole presentation, but I wanted to make it clear to anybody that's watching, this is not this is something that would for unique situations that would be rare. Yes, sir. Thank you. [1:46:21, 1:46:22]: Mm. [1:46:22, 1:46:42]: So the Mayor you finished you finished. I'm ready? Okay. Um so basically we're asking uh I'm coming before council asking for permission to amend the distance requirements from gas stations from forty five hundred feet to eight hundred feet with a special use permit. And add additional requirements for convenience or as we with gas stations. Um [1:46:44, 1:46:45]: Let me go to those theaters. [1:46:48, 1:46:50]: I'm trying to speed it up, Mayor. [1:46:53, 1:47:13]: Okay, so these are additional requirements for a a gas station. A gas gas service station must be located on a property which has furniture on either a collector or an arterial. It can't go into residential or collector streets as classified by the Georgia Department of Transportation or Henry County Department of Transportation. Gasoline. [1:47:13, 1:47:32]: Gasoline service stations are allowed with a base zoning of C3. Gasoline service stations are allowed in the C2 General Commercial District via a special use permit. All property design standards of the base zoning district must be met. Building facades for both primary and accessory structures must be constructed of brick on all sides. [1:47:33, 1:47:37]: A at the stations an equal number of electric charging stations [1:47:37, 1:47:39]: As gas pumps must be provided on the site. [1:47:40, 1:47:43]: Covered canopies must be provided over gas stations and electric charging stations. [1:47:44, 1:47:45]: an acceptable [1:47:45, 1:47:55]: Means of access and internal circulation must be provided to determined by the fire marshal. The required number of parking spaces of the base zoning district must be provided. [1:47:56, 1:48:00]: The required buffers of the base zoning district must be provided. [1:48:00, 1:48:03]: The square footage of the gasoline service stations wants to be at least [1:48:04, 1:48:23]: 5,000 square feet. Must the the gasoline service station must have suites to accommodate at least two sub tenants. All gasoline service stations must meet the meet the other related City of Stockbridge code and ordinances. And other special requirements to be turned by the community development director must be met. [1:48:25, 1:48:35]: Here is the proposed ordinance and it has all those requirements in there. Uh this was vetted by legal uh Valerie Ross. So [1:48:36, 1:48:48]: So basically to sum it all up, we're just asking for permission to replace the uh forty five hundred distance requirement with a special use permit to be approved by council. [1:48:50, 1:48:50]: Okay. [1:48:51, 1:48:53]: Any other questions for Mr. Ryan? [1:48:54, 1:48:56]: Go ahead, please, Ms. Barber. [1:48:56, 1:49:03]: Um so I'm confused. Why explain again, why are we reducing the distance requirement? [1:49:04, 1:49:19]: Um, because we have sep like for instance, say if a a Kroger wanted to come into the city of Stockbridge, a new Kroger or Ingalls or whatever, that they have gas pumps, they can't come into the city right now because of the distance requirements. [1:49:23, 1:49:38]: So what so what what we're asking for, staff still can't approve it, but we just want them to be able to bring their proposals to city council and city coun council review the the proposal and make a determination based on the merits of that proposal. [1:49:39, 1:49:59]: So grocery stores are not one of the one stores that is restricted though. Well, the it's not the store. It it's the gas sales which is prohibited. So we're asking the gasoline sales be reduced to 800 feet with a special use permit approved by city council. They still can't do it. [1:49:59, 1:50:02]: Without coming to get blessing from the city council. [1:50:02, 1:50:08]: So all we're doing is giving them an opportunity to come before council to present their proposal. [1:50:09, 1:50:29]: Okay, I'm just thinking in terms of areas where a Kroger or a Aldies would um submit a proposal. And the only places that I know that there is areas such as this would be in my district, and perhaps his, City Council District Five. [1:50:29, 1:50:31]: So [1:50:31, 1:50:47]: Maybe an uh Well that's that's that's partially true, Council Member Barber, but uh Have you received any requests? I've re I've received some interest, yes ma'am. Okay. Thank you. Yes. [1:50:48, 1:50:50]: Any other questions for the council? [1:50:52, 1:50:55]: All right, seeing none, I need a motion to [1:50:56, 1:51:10]: Uh an emotion to approve this uh change. Mayor, can I say something? Uh go ahead, sir. The Planning Commission uh they recommended approval unanimously unanimously and uh this is part of a public hearing, so you got to open it up. [1:51:10, 1:51:23]: All right. Thank you, sir. Keep me straight. All right. Public hearing. You're absolutely right. Jump the gun. All right. For folks that are here that are uh on my far left side that are approved this, the rest of proving this will make positive comments for my far left side. [1:51:24, 1:51:31]: In the middle or the far right? No comments. Any comments from our far left side and the comments against this particular proposal. In the middle? [1:51:32, 1:51:42]: My far right. No comments for or against Mr. Anderson. Thank you for reminding me about that. All right. Uh council, it's up to you. What's what's your requirement? What's the thing? Motion to approve or disapprove? [1:51:46, 1:51:47]: Male. [1:51:49, 1:51:54]: Yes, ma'am. It has to be a special use permit and they have to have permission, yeah, from council to [1:51:54, 1:51:56]: To move forward with anything. [1:51:57, 1:51:58]: Is there a second? [1:51:59, 1:52:01]: Ms. Barber Sake from Ms. Ganttham. Ms. Barber, all in favor, please indicate. [1:52:02, 1:52:22]: Now it's decision outstanding. Thank you, guys. All right, appreciate it. New business. Council consideration to approve the annual contract RFP 2020-0026 with site engineering incorporated for on-call water and sewer emergency and operational repair, maintenance, and construction services in amount of four hundred thousand dollars as approved by the F. [1:52:22, 1:52:30]: 2025 budget. This is the fourth and final renewal of the on-call utility contract to service to be bidded out. [1:52:30, 1:52:50]: Mr. Aaron, please. Yes, Mr. Mayor and Council. We come before you tonight asking you to renew site engineering for the final time for the on call water and sewer contract. They've been very instrumental in assisting the city over the last seven or eight years with projects, particularly stormwater. They're also [1:52:50, 1:53:10]: able to help us fast track the GDOT project on Highway 138 where they were widening the road. We had to move infrastructure there. So we're just asking that you renew them. It's always good to have a utility contractor on board in case an emergency come up at night. They don't have to follow the process. [1:53:10, 1:53:17]: as we do as far as procurement and things of that nature. So in event of emergency, it'll be a great benefit to us. [1:53:17, 1:53:25]: Thank you. Comments qu uh counsel. Yes. We please. Now I'm I'm amenable to extending contract, but this [1:53:25, 1:53:27]: Number four might be the [1:53:28, 1:53:43]: We've got three in already. Isn't it time to go back out? It's going out to be this is the final renewal. What we typically do is a one year contract. [1:53:43, 1:54:03]: But that's what the R F was one year with four annual four one year renewal. So it's a term of five years after it is completed. Right. But I thought we had agreed that we weren't gonna do that long anymore. We're gonna do about three years, maybe two, three years, and then we would send it back out to the market because that's [1:54:03, 1:54:06]: I mean, uh, how much time do we have? [1:54:06, 1:54:21]: But uh one thing about it, the more time you have on it, the better rates you get, cause you lock in a lower rate, cause right now in the utility industry, prices are escalating tremendously. And we're locked in at prices that we got [1:54:22, 1:54:31]: Five years ago, four or five years ago, they're locked into that price versus what today's current prices are. So the longer the term you typically get better pricing. [1:54:32, 1:54:52]: No, but we don't know what today's prices is because it's been four years now. Yes, we do. Sir, we we have those prices. And like I say, every project that site does for us, one of our engineers review it to either we let site do it or we bid it out based on the pricing. Like when G Dot came to us, we had to move those. [1:54:52, 1:55:12]: utilities they did it for around 130 something the engineer consulted with some firms that do the it was over 400 000 so we are getting competitive pricing using those but if their prices are out of line we bid the project but their prices have been very reasonable when it comes to the [1:55:12, 1:55:16]: all of these multitude of stormwater repairs we've made. [1:55:16, 1:55:24]: It it's just been my experience that the longer the term you tend to get better pricing because you don't have that fluctuation if you do it every two or three years. [1:55:24, 1:55:44]: I certainly kind of agree with what you're saying, but I generally don't like four or five year contracts. I like something shorter to that than to be able to move on. I four or five is a stretch. Maybe three um is uh is kind of where we are now. So if if we did put it back out for bid [1:55:44, 1:56:03]: then with this these they would be able to they would be able to offer up again, right? And they may be rechosen again. Yes, they would they would be it again, but the prices are gonna be higher. Now you got all these tariffs and other things going in into effect, that's gonna greatly impact a lot of things, especially in utilities,'cause you're dealing with a lot of things that include [1:56:03, 1:56:14]: Steel that includes aluminum, copper, all of that that you have the tariffs that is coming from overseas, it's gonna greatly impact the prices, but they're locked into these prices we currently have. [1:56:15, 1:56:18]: Okay. Okay, thank you. Yes, Ms. Barber. [1:56:20, 1:56:33]: Thank you, Mr. Aaron. Um and Councilman Alexander he's funny. Um thank you, Mr. Aaron. I do see you did note on here that it is the fourth and final renewal. Yes. And I agree with everything that you've said. [1:56:34, 1:56:35]: They are locked in. [1:56:35, 1:56:36]: Any rate. [1:56:37, 1:56:49]: until this current contract expires. It is advantageous for us to renew this again locked in at whatever rate we already we already have with them. [1:56:49, 1:56:52]: So I do support rebidding this though. [1:56:53, 1:56:57]: Yes, we are gonna rebuild it. This is the final renewal. I see. I see you haven't noted here. [1:56:57, 1:56:58]: Um [1:56:59, 1:57:07]: One of the things that would have been helpful though, I'd like to see how much we actually spent with site engineering in 2024. [1:57:08, 1:57:10]: The entire year. [1:57:10, 1:57:18]: Get an idea. I can I can get that straight. We don't have that information. I can get that to you. The majority of it has been stormwater free. [1:57:20, 1:57:20]: That's okay. [1:57:20, 1:57:21]: That's okay. [1:57:22, 1:57:23]: Um this is fine. [1:57:24, 1:57:28]: If the council doesn't have any other questions, I will make a motion, sir. [1:57:29, 1:57:42]: Mayor to approve this so we can move on. We'll just ask the council. Any other anybody got any other questions, concerns? If not, then go right here please. Okay. At the recommendation of uh Mr. Aaron, um [1:57:42, 1:57:51]: I support approving of the annual renewal of this site engineering contract, not to exceed the four hundred thousand dollars. [1:57:53, 1:57:56]: I second. Okay, Ms. Gantt, second. All favor, please indicate. [1:57:56, 1:58:16]: Thank you, sir. Appreciate it. Thank you, sir. Okay. Council consideration for approval to replace the grass seeding area in an amphitheater with FBI Flex PAVE in the amount of$165,000. Yellowstone landscape is$58,953, and KBI Industries Incorporated$98,095. [1:58:16, 1:58:22]: Funny source would be Splos. Once again, Miss OK. Ow. Al is here. Who is her? [1:58:23, 1:58:39]: Yes, good evening, Mayor and Council. Um I'm here to present a recommendation for changing a lawn at the amphitheater for the flex plave. Um you should have a little bit of information as far as pricing as well as the [1:58:39, 1:58:42]: The brochure that they provided for us. [1:58:43, 1:58:51]: Um, I do have a little PowerPoint presentation so you can kinda see the condition that that lawn is in when it's in an off season. [1:58:51, 1:58:54]: Then go ahead, sir, please. [1:58:57, 1:58:58]: Oh good, right here. [1:59:02, 1:59:03]: Okay. [1:59:05, 1:59:06]: I think that's it. Okay. [1:59:15, 1:59:16]: Skip. [1:59:19, 1:59:24]: Арай, зрай, аз, амптиат, [1:59:25, 1:59:27]: for the community as well as to bring [1:59:29, 1:59:40]: um acts and different types of events to our community. Um with the lawn you see right now is basically the the condition it was when we was first built. [1:59:43, 2:00:03]: This right here is what the lawn looks, and this is the issues of the lawn. It has pathways in the off-season, sinkholes. You can also see matted grass and hills. Right now it has heavy traffic use. For my recommendation, for my understanding, that it was not built for. [2:00:03, 2:00:09]: To have seating on it. It was basically for lawn chairs, blankets of sorts. [2:00:12, 2:00:16]: I got that, but it cuts down on your attendance by the way too, by the way. So I know. [2:00:17, 2:00:37]: This right here is Flex Pave. I also do have some samples that you all can hold and actually take a look at. I'm sorry I didn't get that to you soon enough. But this right here is just basically a description of Flex Pave. Um it has pores, it's able to have water run through it. So also with the system that we [2:00:37, 2:00:47]: currently have at the amphitheater the drainage we wouldn't have to do n nothing to it. It would actually water would just drain straight through it as if it was a lawn itself. [2:00:48, 2:00:50]: That's just a brief description of it. [2:00:52, 2:01:01]: Um also you the features and benefit, it does not crack like typical pavement. Um is easy to clean. [2:01:02, 2:01:15]: And also down here has the benefits for it as well as the improve the water quality, cleans water as it passes through the material. It manages storm water as well. [2:01:15, 2:01:23]: And it's also conducive with the environment. This is disused by tires as well as recycling material. [2:01:28, 2:01:40]: Um this right here is examples of some pictures. Um is also used on um Atlanta um Beltway, the Beltline Project as well. But this right here is just a couple of pictures. [2:01:46, 2:01:47]: I suppose we [2:01:48, 2:01:50]: It could be feel true like a different. [2:01:52, 2:02:12]: The spree. Uh flex pave would also uh reduce operating costs. It would kinda it would actually lower the cost of having the lawn service in there as far as cutting, wheat eating, and trying to treat as far as fertilizing as well. So this offers a long time um lifespan. [2:02:12, 2:02:18]: And it should revitalize the seating of the amphitheater along with the rebranding of its name. [2:02:19, 2:02:22]: So we should have added another look to it as well. [2:02:24, 2:02:26]: And that's the end. Any questions? [2:02:27, 2:02:33]: Well I I have to admit I like the concept. I hope that the council will approve this. Go ahead, Mr Alexander. [2:02:33, 2:02:53]: I like the concept, but this is hard as a rock. And um I think uh what I kinda had in mind was maybe like the prescription athletic turf that they use on the football fields. Mm-hmm. This scene I don't know, maybe it's just a sample of how the sample look. Because if you lose on the uh the what they use on the football fields is [2:02:53, 2:02:55]: You know, if you fell on this [2:02:56, 2:03:04]: Well you you hopefully people won't be following on you. I'm just but but I'm saying you know how people do, right? I mean somebody gonna try to whatever the case may be. Uh Mr. Young, can you come up [2:03:06, 2:03:26]: But again, this I don't know, maybe this is just what the sample is like. Is this what it's actually gonna be like or is this just what the sample They have actually um I think Miss Barber has the one that is actually a little spongy. A lot of spongy. But also you have to think we're putting seating on top of that. Right. [2:03:26, 2:03:27]: Yeah. [2:03:28, 2:03:29]: Yeah, you know this is a [2:03:29, 2:03:36]: You need to emphasize that. Right. You put in what I got. Well water water does go through it. [2:03:37, 2:03:55]: But but what I'm saying is that you do you understand what I'm talking about? On the football field, it's like y'all been on the p you've been on the athletic fields that have the uh prescription athletic turf where it's it's not this hard. It's like it's almost like it feels like real grass. You've been on the one turf field? [2:03:56, 2:04:16]: The uh the advantage uh first of good evening, uh the advantage of that product is first of all you're putting chairs and you're sitting on it. So the problem that we're having is that the weight now we have dirt and um when people sit down when it rains, people seeking her into the ground. [2:04:16, 2:04:36]: So that was sustain people from falling. Right. It's not so much of, it's also a look too. It'll be a nice clean look all the time. And we have to worry about what's happened is last year we did 12 um, we had to move the chairs$12. Every time we move the 12s, it's$1,700 approximately. We're talking about [2:04:36, 2:04:51]: close to twenty thousand dollars and just moving the chairs the lawn. Just to mow the lawn. That that is hard. Just to just to move the chairs. Yeah. Yeah, so I mean so it's it's it's it's very, very I mean the way the things are right now is very costly. [2:04:51, 2:05:06]: Before I c before I close and and I think the other councilman has some other questions too, we had discussed actually doing some turf down in the pit area because it's a hundred and ten degrees when the s when the sun is shining down there. [2:05:06, 2:05:15]: What would do well, we don't have an estimate on being able to do that and now we got a sponsor. Certainly we should have some dollars to be able to fund that because [2:05:15, 2:05:19]: In the summertime when the heat is shining down on that pit area and [2:05:20, 2:05:22]: It's a hundred and ten in there. [2:05:22, 2:05:39]: This would actually help lower the temperature on the concrete. Uh if we were to actually invest in some type of artificial, cause that concrete is so hot. Even on a ninety degree day, it's too hot. So what can we do about adding that in, whether we do this or another material? [2:05:41, 2:05:48]: Okay, well one of the things I don't know if you if you really know about turf. Turf has little rubber pellets in it. Mm-hmm. [2:05:48, 2:05:50]: So as people walk [2:05:50, 2:06:10]: You know what saying no little pellets would kick up. So if you if you watch last night's Super Bowl, you will see when they stumble, they fall, they kick up, there's little pellets that are on turf. You know saying so. Then you have to look at a maintenance as far as with that. So that is not just something that you just put down and you just leave with chairs and tables moving. [2:06:10, 2:06:22]: moving across that. Now you aggravating the little pellets that's within that turf. Then also um we did look into getting before actually coming across that, looking at doing turf. [2:06:23, 2:06:25]: Up there on the top of the area where the grass is. [2:06:26, 2:06:27]: Then you have to worry about [2:06:28, 2:06:39]: You know, the little artificial grass sticking up, laying down with the chairs and tables that's constantly sitting down on it. Now you're gonna have little, you know, saying spots and divots all inside of that. [2:06:40, 2:06:40]: Mm. [2:06:40, 2:07:00]: I was before you do it, I would say to you that in reference I would think that this will be phase one. If we wanna look further to the pit area, fa maybe phase two, do this in phases this is already green. We don't keep the green color, this aspect. Um I would think that uh you know we can uh get this done now before the concert season and look at uh maybe next year doing doing another [2:07:00, 2:07:10]: something else in phase two. That's my initial thoughts. Yes ma'am, go ahead please. Well m you know, initially I understood the concept of oh, you want it to be a little spongy, but [2:07:11, 2:07:16]: Women wear heels at their concerts, right? And then you have your chairs, which [2:07:16, 2:07:21]: Put weight down which punctures holes into that spongy. [2:07:21, 2:07:30]: thing. So to me, these this works better with heels. You're not gonna have those indentions and it's not gonna tear it up. Whereas you walk down [2:07:31, 2:07:34]: On that sponge thing, n not even one day. [2:07:34, 2:07:41]: I mean that's it's gonna puncture. Somebody's gonna puncture, you know, based off of weight or size, whatever, you never you never know. [2:07:41, 2:07:50]: But I think that this works now, it might be harder to walk on. I don't know. It's a little rougher, kinda like a rockier sur surface, not really smooth. [2:07:51, 2:07:51]: But [2:07:52, 2:08:02]: you don't want it to puncture and the the softer material's definitely gonna puncture, even with the chairs. I mean, it'll pun you sitting and it it's gonna puncture. So you wanna make sure [2:08:02, 2:08:07]: That whatever we get doesn't puncture what we're purchasing. Ms. Bs Barber Good, please. [2:08:07, 2:08:10]: Yeah, I wanted to ask um Mr. Aaron [2:08:11, 2:08:14]: Is this an item that was budgeted for this year? [2:08:16, 2:08:36]: So uh I'll let uh Frank speak to that. But one of the things I also want to wanna mention is that the softer one, you gotta think when it's a hundred plus degrees or nine and plus, it's gonna get even softer than what it is. And so now you're gonna have folks kind of [2:08:36, 2:08:56]: But we're not getting this off on. We already said that. Even if if you went to the artificial turf, you would have to put a base under there, which more than likely would be concrete, and you put the turf over the concrete. So you kind of defeat the purpose of what you're you're trying to do. And this firm firmer process. [2:08:56, 2:09:03]: product will give you a better product and also the look that you're looking for. I think the people just want to be comfortable [2:09:03, 2:09:18]: And when they sit down and not sinking or falling or something like that, and I think that one will give you what you're looking for. Well I agree, like I said, the pit area. Mr. Malazi Is this an item that was budgeted? [2:09:20, 2:09:36]: This was approved in the SPAS and SPAS is coming in sometime April, May, and they can't wait for this project. So we are taking money in place of SPAS and replaced once Splas comes in. [2:09:36, 2:09:46]: So what I'm asking is the FY twenty twenty five budget that was approved. It was this an is this a line item? [2:09:46, 2:09:48]: In the budget. [2:09:48, 2:09:49]: For the amphitheater. [2:09:50, 2:09:53]: It's one of the allocations that they made in this class. [2:09:54, 2:09:56]: In the splast. Yes. [2:09:56, 2:09:58]: But is this a project? [2:09:59, 2:10:01]: That was a line item. [2:10:01, 2:10:02]: In the budget. [2:10:03, 2:10:03]: Four. [2:10:04, 2:10:05]: The amphitheater. [2:10:06, 2:10:09]: No ma'am, not of this [2:10:10, 2:10:13]: That's all I'm asking. Okay. My next question [2:10:14, 2:10:28]: My next question, the maintenance. Depending on whichever grade of this that you suggest to us, what is the maintenance like? How often do you replace or have to [2:10:29, 2:10:49]: You were replacing if they're damaged, it's just like the fixed seating you have in there. This could be from seven to ten years depending on the the traffic on it, the amount of people that are sitting on it and things of that sort. And it's gonna get weathered because it's out in the weather, just like we replaced some seats already in the amphitheater. Everything has a life expectancy, but [2:10:49, 2:10:51]: This would be seven to ten years. [2:10:53, 2:10:58]: Okay. Um these companies um that you have [2:10:59, 2:11:01]: I guess quotes from [2:11:01, 2:11:03]: They offer warranties. [2:11:03, 2:11:04]: Yes they do. [2:11:05, 2:11:09]: Can you share some details about the warranty? [2:11:10, 2:11:16]: It should be in that brochure that's a part of your package. Just for the public's knowledge. [2:11:36, 2:11:39]: Okay. Uh excuse me. [2:11:41, 2:11:47]: It's a one year material warranty. Extended warranties are available with the additional maintenance program. [2:11:48, 2:11:52]: The additional maintenance program, is that an extra cost? [2:11:53, 2:11:58]: Yes, that'll be a extra cost. Do we know what that extra cost is? [2:11:58, 2:12:02]: No, I don't have that at the um present time. Okay. But I can get that to you. [2:12:02, 2:12:03]: Thank you. [2:12:04, 2:12:09]: Oh, I'm sorry, one more. Mr. Aaron, so which of these grades are you suggesting? [2:12:11, 2:12:29]: I would re while different. I would recommend the the solid one, the more solid. You had the spongier, softer one. But I think Councilmember Gann or Councilmember Berry. No, it's not. It's a brown. [2:12:31, 2:12:38]: I need for you to tell me which one exactly. [2:12:39, 2:12:45]: Okay. [2:12:45, 2:12:46]: Really. [2:12:50, 2:12:55]: I don't see. Like the green. It looked like red. [2:12:58, 2:13:00]: Yeah. [2:13:04, 2:13:20]: Yeah, Miss Barber, there's one that's just soft, but all of them are the same. The only difference is the samples are just the different colors that they come in. But the only one that is different from all of them is that spongy one, the very first one that you had. But the rest of them are all still the same. They're just different colors. [2:13:21, 2:13:21]: Mm-hmm. [2:13:24, 2:13:30]: All right. My qu my question is is probably on the same line. [2:13:30, 2:13:50]: The qu the problem we're having is with the heat. And so this is still like a rock, a granular type material, which is seems to be akin to the concrete that it's gonna push off heat. So my question is, have they given a rating of how hot this material gets? Does it reflect the heat? [2:13:50, 2:13:59]: Does it absorb the heat? Like what's the UV rating on it? Like what is what is what are they saying? I didn't see anything in the presentation about the the temperature. [2:13:59, 2:14:09]: of this material.'Cause that was one of the things that we we've all kind of shared the sentiment about is that on the summer hot days it's right. It's smoking. [2:14:09, 2:14:25]: Well that's you're talking about the pit now. The grass area is grass right now. But if we replace it with this and it doesn't have the absorption of grass. It's porous. Yeah, it's pour straight through. [2:14:26, 2:14:40]: So like that that water rod runs through that and everything, like he said, and then it has a base that is a gravel base. I get the water, but I'm saying what what does the sun do when heat hits it? Does it reflect the heat? Does it absorb the heat? [2:14:41, 2:14:46]: Like we're I get the water absorption part and we don't have to deal with that. So [2:14:46, 2:15:06]: It's a porous material. It's gonna absorb heat, but we gotta keep in mind too. We're outside in the Georgia heat. If it's 98 plus 100, I don't care what surface it is, artificial turf gets extremely hot, concrete's gonna get hot, asphalt gonna get hot, but this is in use on the Atlanta Belt line, and people are running and walking on it every day. [2:15:06, 2:15:13]: They in all type of conditions. So we just gotta keep in mind that something no matter what you try. [2:15:14, 2:15:20]: You know, n nature wins sometimes. It does. And and so that leads me to my next question is [2:15:20, 2:15:40]: I've seen it. I've been on the belt line before, and I I know that sometimes just like with the pellets and the uh turf, sometimes these things break off too over time. In certain especially the heavier traffic areas, it breaks apart too. So I'm concerned about the the one year warranty. [2:15:40, 2:15:42]: That they offer on material. [2:15:43, 2:15:44]: Is [2:15:44, 2:16:04]: But if that's a concern, there's also an extended warranty we can get. But it it would be no different than like the the playground equipment we have at Clark Park that we put under the playground equipment. We replace some of those, but the majority of it is still in place, still works and functions the way it is. [2:16:04, 2:16:10]: It intent it intended to do and that's been at least over seven years. [2:16:11, 2:16:25]: Little spongy. It's similar to this. I know it's similar, but is it exact same? Is it No, it's not that's more of a sponge type. It's a s it's a smoother and softer, pliable material because you got kids jumping and falling on it. So that's exactly right. [2:16:26, 2:16:32]: But it is it's not porous like this and it and it doesn't really absorb heat like this does. [2:16:34, 2:16:54]: B besides this long term I think it'd be beneficial for us because obviously i if we didn't change it out, just got the constant grass cutting, edging, the movement of the chairs, uh so often with that the the labor for that aspect as well and its overall look. Uh you saw pictures earlier in the presentation where it looked w when it first was uh put in the [2:16:53, 2:17:13]: [8233.9, 8244.3]: that cost them, you want to have that look and it'd be natural grass, then you'll probably resaw it that two or three times during the concert season to have that look. So [2:17:25, 2:17:44]: This will also allow us not to have to move the chairs on every between every concert and get grass cut as well. Save on that money long term as well as the the the guys that are moving that concert all the time, put the chairs back in the in the right order. Yes, sir. I'm sorry, Question Where? Miss Barber, go ahead please. Yeah, I need to ask. Um [2:17:45, 2:17:47]: Has this gone through the competitive bidding process? [2:17:49, 2:17:59]: So in order to we were requested uh to try to fast track this before the concert season starts. Yep. So no, if you let me finish. [2:18:00, 2:18:05]: K is their own state contract, so it has been competitively bidded. [2:18:05, 2:18:25]: They are a source well vendor. So and Yellowstone is one of our vendors, current vendors as well. So you would amend the agreement or contract you have with them to allow them to do the prep work for the installation of this property. Okay, so are you saying that you're going to piggyback off uh source? [2:18:25, 2:18:41]: Yes, ma'am, for the flex. Thank you, sir. That answers my question. If in fact that is what your intent is to piggyback off of a state contract with Sourcewell for this. [2:18:41, 2:18:46]: The reason why I'm asking, I wanna make sure that we're getting the the best deal. [2:18:46, 2:18:53]: That was the only way we could fast track it is find someone that we can piggyback off the source well contract. So that's why we did it that way. [2:18:55, 2:18:56]: Any other questions? Question. [2:18:56, 2:19:00]: Legally that's what you had to do, that was required of you. Yes. [2:19:00, 2:19:14]: Now, Mr. Malazzi, could you step to the podium? Now we're taking these funds out of SPLOS, right? That is correct. Right. So in this SPLOSS account that you're taking out of how much money is in that account? [2:19:14, 2:19:34]: So as I said that uh you plus when it's coming is allocated. During that allocation there are things that has to be done in January and this is one of the program that they found that it can be uh used. [2:19:34, 2:19:39]: in the amphitheatre side. Splash is not yet to come. [2:19:40, 2:19:44]: It's going to come down the line April May. Mm-hmm. [2:19:44, 2:20:00]: And between now and then we have money that they can use. When sa uh splash money comes, we put back one sixty five. So right now we're bringing in what? About five hundred something thousand dollars a month in the splashed? [2:20:00, 2:20:13]: We will be getting about seven hundred thousand when it starts coming in. Right, but I'm saying right now we have splash four, we have splash five, we have additional splash in addition. But this is the plus six where the money will come from is plus six. [2:20:13, 2:20:30]: Right. So in essence what is going to happen is and and I know Mary you you kinda wanna wanna be hesitant on this, but if we got SLOSS dollars coming in and we're gonna have a contractor already out here, it would be cheaper to get it done now'cause we know the price is going to go up. [2:20:30, 2:20:34]: And I and and with all due respect, Mr. Aaron, we know [2:20:35, 2:20:55]: That it's gonna be hot, and certainly Georgia is gonna be hot everywhere. But that turf is gonna be a lot less hot than that concrete, because that concrete in the pit area is totally unbearable. All of us have been in it. It is totally unbearable when you're down there and you're trying to enjoy the contrary. [2:20:55, 2:21:09]: insert and it's 110 degrees. Now we already know that's what happens uh on when you have concrete because concrete without a doubt reflects heat at a higher rate than anything else. Period. [2:21:09, 2:21:12]: And having guests come and sit on that. [2:21:12, 2:21:17]: It is unbearable. So we could reduce it by five degrees. [2:21:17, 2:21:28]: or ten degrees or whatever that case may be, it certainly would be beneficial to do it if we could do it. I I n I don't know, like I said, I just know we wanna be cautious into what we're doing. [2:21:28, 2:21:45]: But to send our folks through another year of a hundred and something degrees in that pit and they're paying three hundred and something dollars, and we got a vendor now with uh with ViceStar, certainly they probably would appreciate it. Mr. Young, your thoughts? [2:21:48, 2:22:08]: Well f uh first of all thank you because it it is hot. I mean and we c we can't we can't uh deny that. The thing that I was uh if we can get this done it has to be done in phases, as long as it gets done. Uh if we have to do this now, get this grass done first and then the pit [2:22:08, 2:22:28]: Um you it's definitely has to be done. The pit de I mean, you can't go uh a few more seasons like this because we don't know what the climate's gonna look like. It's getting hotter, you know, and and people we've had some medical issues with people getting uh overheated, but it doesn't it I would suggest if we just get this grass done first. [2:22:28, 2:22:48]: And then if we it I mean, I don't know your I'm I don't know the financial situation. I just need to know that the grass needs to be done first because it's a problem. Chairs are sinking in the dirt. Right. Um people can we we can have potential uh medical condition where people can get hurt because those chairs, that's the next thing later we're gonna replace those chairs. [2:22:48, 2:23:08]: Because they're getting rusted and be and it's it they're not outside chairs. Um there's a lot of things that need to take place with the next uh SPLOSS allocations that I'm gonna present to you all also, because there's some things that definitely need to be done to better the amphitheater experience. What I'm saying is I don't want to slow down what we're doing tonight. [2:23:08, 2:23:10]: Let's go ahead and do [2:23:10, 2:23:17]: Right now the grass that has been suggested. But let's immediately turn to the pit. [2:23:17, 2:23:37]: And let's go ahead and try to get the pit done too. We don't want to hold this up. You gotta go out and get a estimate for it anyway. Let's go ahead and get the estimate now and to see whether what could be done. They can go ahead and install right now uh the grass up in that other area. But let's uh let's find out what it costs and then the s we start. [2:23:37, 2:23:39]: What the collection win, Mr. Malazi? [2:23:42, 2:24:02]: End of April or May. End of April, right? So the c the first concert's not until May the third. But we will have this already installed and then maybe the first couple of concerts we might not have it down there. But by the time July rolls around, when it's uh or past Father's Day, when it's a hundred degrees out there, we could have [2:24:02, 2:24:11]: Have it done by then. And I understand the phased approach, but we do this now and then circle back to the pit area uh by summertime. [2:24:12, 2:24:14]: All right. Ms. Barber, you had another comment? [2:24:14, 2:24:20]: I wanted to ask, um I just think we need to do better planning. Um we are [2:24:21, 2:24:31]: what two, three months from the very first concert. So if this was something that we wanted to see happen, and I know the council has talked about it, the grassy area [2:24:32, 2:24:35]: About doing something we've talked about this a few years now. [2:24:35, 2:24:39]: These are discussions that I would hope that we would have during the retreat. So [2:24:40, 2:24:46]: We could have more robust discussions such as this. Um I do agree. [2:24:46, 2:24:53]: I agree about the comments in the pit area, how hot it is. I agree with the grassy area. [2:24:54, 2:25:00]: What I'm challenged with though is I know if we got a quote [2:25:00, 2:25:08]: To cover both the grassy area and the pit area, the cost would be more beneficial for us. [2:25:09, 2:25:11]: If we got a quote together. [2:25:11, 2:25:15]: But if we're gonna piecemeal this, we're probably gonna be paying more. [2:25:15, 2:25:16]: On the front, Ian. [2:25:17, 2:25:18]: That's what I'm challenged with. [2:25:19, 2:25:21]: That is what I have an issue with when [2:25:22, 2:25:23]: When things like this are kinda [2:25:24, 2:25:25]: Dropped in our lap. [2:25:26, 2:25:29]: And we're forced to make a decision like [2:25:29, 2:25:30]: Right now. [2:25:31, 2:25:34]: Had we not planned for this and actually budgeted? [2:25:34, 2:25:36]: For this particular project. [2:25:36, 2:25:37]: Last year. [2:25:38, 2:25:39]: So I'm I'm torn. [2:25:40, 2:25:41]: I know it has to happen. [2:25:41, 2:25:42]: It needs to happen. [2:25:43, 2:25:48]: It's just we haven't planned for it properly. That's all. [2:25:48, 2:25:53]: Um, have y'all thought about like a maybe [2:25:53, 2:25:54]: Some type of [2:25:55, 2:25:57]: Down in the pit area. [2:25:57, 2:26:07]: I mean, I think that we when we the reason why'cause at first I was like, Well, why don't we just make it concrete like the rest of it? But when you really think of that, you know, [2:26:08, 2:26:13]: the the vision and the look itself is a part of [2:26:13, 2:26:28]: the why the amphitheater and the ambiance is what it is. Have you ever thought about maybe a some type of flat red rug, carpet down on fixed, covering the concrete on the bot on the pit area? [2:26:28, 2:26:33]: Maybe that brings out the the VIP ish. [2:26:33, 2:26:39]: Uh no, I'm not saying black. I'm saying red. A red uh like a red felt tight [2:26:40, 2:26:41]: Bixed [2:26:42, 2:26:55]: You have weather that you're gonna deal with. You got what? You have weather issues when you have I know. Uh huh. But is there some type of product? What what I'm saying is you we [2:26:55, 2:26:58]: We looked at the design is made. [2:26:59, 2:27:02]: To show different dimensions. Does that make sense? [2:27:02, 2:27:12]: Right. And and you take away from it by making everything one thing bland. It's just like any other amphitheater. But the way ours is so unique. [2:27:13, 2:27:21]: So the color scheme of that hard surface that you guys got right there would hopefully be the green, just like the grass was, right? [2:27:21, 2:27:31]: But what about d if we were to do something down below? I mean, I guess we could keep it the gray or however you want to do it, if you wanted to use that same surface. Or [2:27:33, 2:27:34]: Or [2:27:34, 2:27:37]: Have some type of breathable [2:27:38, 2:27:45]: Flat surface and I I don't know what that what that would be. I don't know if y'all have looked into that or not, but I just thought it would be kind of unique. So [2:27:45, 2:27:50]: One of the things I I wanna address what Councilmember Barber said about [2:27:50, 2:27:57]: The pit and the grassy area, the instructions we were given, there was a concern about the grassy area. The pit was never mentioned. [2:27:57, 2:28:01]: So our instructions were to look at an alternative to the grad section. [2:28:02, 2:28:14]: section of the amphitheater and that's what we did. Now, you know, we're hearing about the pits. We can try one or two options. We can also, on a temporary basis, to see what happened. You can put some type of turf [2:28:14, 2:28:33]: or outdoor carpet, that's nice. And cover that area, leave the drains open so that water drains out of it. And you go a few shows and you see if that actually lowers the temperature. If that helps with the heat down there, then we know we're following the right process and we can put in some type of [2:28:33, 2:28:53]: uh surface like that. But it'll give us an idea because if if you invest a lot of money in something and you still have the same issue, then we're gonna say, well, we invested all of this money. So I think that allows us to get some type of idea of what we need to cool that area down to make it more comfortable for [2:28:53, 2:29:05]: Canopy, some type of covering. I don't know. I know maybe you block the view of I know. I thought about that. You're blocking the view. So but if there's some unique [2:29:06, 2:29:07]: Uh [2:29:07, 2:29:18]: porous type it looks like carpet but maybe it's not carpet, right? Or it's something but it's flat because it's laying on that concrete there. I'm just thinking maybe there's some type of product that we have. [2:29:18, 2:29:27]: All right, Miss Salz and Mayor, you remember we was up at Sandy Springs and they were tearing up all that dirt and they were putting down turf. [2:29:27, 2:29:47]: In that amphitheater right in front of City Hall. Remember that? They were doing the construction on there and they were putting down turf right there. So, whatever the product they're using, I'm sure they probably they probably went down this same road that we're going down now. Maybe we should give them a call and see what it is that they did because that's what they're doing. [2:29:47, 2:29:52]: they were doing. They had the dozers out there and it was on um, you know, putting down the turf. [2:29:52, 2:29:59]: Yeah. Okay. That's something to check into. Is that now you're talking about just for the pit area or you're talking about the pit area. Just for the pit area. Okay. [2:29:59, 2:30:00]: All right. [2:30:00, 2:30:15]: Ms. Barber, go ahead please. Therefore, if there are no other questions, comments, I'd like to make a motion so we can move forward with this. All right, go ahead please. Um I move to approve to replace the grass seating area at the amphitheater.
