Right here at Stockbridge folks with Community Connect. I tell you. [0:09:18, 0:09:23]: Um this next proclamation. As a matter of fact, on this case, uh this would you come back up please? [0:09:25, 0:09:26]: Ha ha ha. [0:09:30, 0:09:50]: So Unity Grove Rosenwald School. Whereas as part of American history, Rosenwald Schools, as they've been commonly called, began as a partnership between Julius Rosenwald and Brooker T. Washington. Mr. Rosenwald was a president of Sears of Robock and a wealthy man. Mr. Washington was an educator, civil rights [0:09:50, 0:10:10]: Activists. They were very concerned about the conditions of rural schools in the South for African-American children, developed a plan to encourage the community to work together, raise funds, and acquire grants to improve the schools. Therefore, a catalog of schoolhouses in the Rosenwall schools, which became a very popular across the southern United States, with the segregation of schools. [0:10:10, 0:10:18]: Most of these buildings were no longer needed. Some were replaced, but many were eventually torn down and rotted out, rotted away. [0:10:20, 0:10:40]: There are very few left today, one of which was the Stockbridge Georgia Rosenwald School. And whereas the Unity Grove Rosenwald School building is still standing in Local Scrooge, Georgia, right here in Henry County, of course, on private property and a significant historic cultural artifact. Its presence alone conveys information about its uh social structure, technology, [0:10:39, 0:10:59]: Economics, educational system, the core values of rural society in the southeastern United States during the first half of the 20th century. UGRS is a social barrel of what originally was were eight Roosevelt structures built by the Board of Education in Henry County, Georgia. It was constructed in 1931 and last operated. [0:10:59, 0:11:19]: As a county public school for African-Realing Children's Spring Termination 1954. Whereas upon Henry County Board of Education approval, plans are to move the school from its current site and place it on the campus of Beaten Grove Elementary School. Now, therefore, I am as for a virtual authority investing me as a mayor of the city of Starbucks, Georgia. And on behalf of City Council members. [0:11:19, 0:11:39]: Hereby recognized the significance moment and ongoing preservation effort of Rosemal Schools further demonstrated demonstrated their strong support for protecting these historic places and helped highlight the incredible stories of this chapter of American history. Brooker T. Washington of the Tuskegee. [0:11:39, 0:11:59]: Institute and Julius Rosenwald, Philanthropist, and President of Sears and Robert Company built state-of-park schools for black children across the South, an initiative transformation transformative, excuse me, that will help shape the educational and economic futures of the entire generation of children. A witness thereof I have here undo set my hand for great seal. [0:11:59, 0:12:10]: City Starbury, Georgia, 12th day of February year of our Lord, 2024, and I signed the proclamation along with our Plato National Holiday. [0:12:20, 0:12:23]: All right. Any additional words that you may want to say at this point? [0:12:23, 0:12:43]: Um, I do want to say thank you to the mayor and council for the support of this awesome historical school. Um, it during this time back in the 1950s or so, it brought the communities together. Um Julius Rosenwald and Rooker T. Washington literally allowed funding to be available for the construction of the schools. [0:12:43, 0:13:03]: Because back then African Americans didn't have great structures to get education. But what was most important was that they required, in order to get the funding, that the blacks and the whites and the Board of Education had to come together to make this school a reality for those who are renowned today. So I want to say thank you to each of you council members. [0:13:03, 0:13:23]: Thank you, Mayor, for helping us to preserve this school. Our goals is to turn it into a museum and also an educational facility and a community facility where we can continue the focus of unity in our community and the focus of education for our children. So thank you all here. Thank you. So on that note, Human Trafficking Prevention Awareness Month. Whereas Human Trafficking is a nationwide [0:13:45, 0:14:05]: Public health and civil rights crisis. Its victims and survivors are everywhere, as stopers as being no exception. And whereas human trafficking includes both labor and sex trafficking with both international and domestic victims. And whereas anyone can become a victim of trafficking, while women and girls are primary victims, victims survivors come from [0:14:05, 0:14:20]: Every background, race, gender, sexual orientation, economic status. Traffickers target individuals who, for any reason, are vulnerable. Whereas young people are particularly vulnerable to trafficking and exploitation, but face many barriers and reporting to what is actually [0:14:20, 0:14:40]: Happen to them. Whereas all communities must seek and prevent human trafficking before it can occur by promoting safe, healthy, and supportive environments. Whereas the city of Stockbridge is striving to become a place where human trafficking does not exist by providing forms, workshops, and information to educate to educate our citizens. Now, therefore, I am asked more by virtual authority. And I have hereundo set in my hand the Great City of the City of Starbucks, Georgia, on the 13th of January year of our lower 2000. [0:14:59, 0:15:05]: [915.7, 935.7]: This initiative was something that um I helped Spearhead bring to the city. It was the first municipality to recognize the seriousness of this heinous crime, which is human trafficking. Um unfortunately, Atlanta finds itself, the Metro Atlanta. [0:15:35, 0:15:55]: Area finds ourselves in is the number one hub for human trafficking. If there's anything that you can do out there to raise awareness about this crime taking place, please do that. Understand the signs to look for when you're traveling and that type of thing. They try to bring that those awareness to you to make sure that you are. [0:15:55, 0:16:15]: understand that somebody is put into servitude in the year of 2024 is completely unacceptable. We understand the dangers that lurk right into our homes via the internet every single night. Young girls and young boys run away from home thinking that they're running to somebody in safety. [0:16:15, 0:16:35]: This is something that we have going on, unfortunately, right here in this county in the city. It is all over the Metro Atlanta area. [0:16:35, 0:16:55]: Each and every one of you could be that extra set of eyes to bring attention to this heinous crime. Please do that and understand that it is going on right here in this community, and we need to do something about it. And we want to be able to recognize it here. And again, I said we step forward with this as the first community, other communities, the county, and everybody. [0:16:55, 0:17:15]: Else has has also passed this proclamation now. Because, you know, the thing about it is they teach you these techniques that as you go and you gain more information on this, is like when you're trying. [0:17:15, 0:17:35]: Traveling and you notice that uh someone is traveling with a young person, and that young person can now make eye contact. That young person gets up and goes to the restaurant. That person follows them to make sure that they have no access to be able to talk to anybody or to share anything. Those are kind of the signs that you would look for when. [0:17:35, 0:17:40]: No no prom sorry. Well, thank you very much for that message. [0:17:44, 0:17:46]: Okay. [0:17:46, 0:18:06]: And ladies and gentlemen, you've got to continue to bear with us here. I pledge allegiance to the flag of the United States and to the Republic of which State. One nation. One liberty. [0:37:27, 0:37:28]: Just as well. [0:37:34, 0:37:35]: Madam Clerk, Rucall, please. [0:37:37, 0:37:55]: Mayor Ford? Present. Mayor Pro Tem Berry. Present. Councilman Alexander. Present. Councilmember Barber. Present. Councilmember Gantt. Present. Councilmember Thomas. Present. [0:38:23, 0:38:27]: Thank you very much. The unanimous decision on that note. What before you c uh before you counsel you have [0:38:28, 0:38:40]: The adoption of minutes uh from the January eighth meeting, uh council meeting and also from the January third council work session. If there are no other changes of that or revisions of that, I need a motion to accept those into the record, please. [0:38:41, 0:38:42]: I need a motion, please. [0:38:44, 0:38:53]: So moved Mr. Mr. Berry. Is there a second? Second. Oh Mr. Alzheimer's. All in favor, please indicate. Thank you. Thank you very much. Uh Madam Clerk, do we have any public comments at all? [0:38:54, 0:39:14]: Thank you. Thank you very much. Appreciate it. Ladies and gentlemen, I want to briefly go through the ceremonial review. Most of you are probably here for this without a doubt. So we have several different proclamations. We did a proclamation of Black History Month, which is February. Human Trafficking and Awareness and Uh Prevention Month, which was actually last month, but we did this uh delayed, but we did it today. Union Growth Rose and [0:39:14, 0:39:34]: Wall School and also a Miss Riley for Flip City South, an outstanding achievement by being fourth in the in the world in a tumbling competition that was held in England. So a Stockbridge residence. So we're very proud of her on that aspect as well. And of course, uh what we I did several different swearing-ins with you present there. Uh the youth uh council advisory member, Shakar Sell. [0:39:34, 0:39:54]: Was brought in for another swearing in there for a few more, four more, I think it's four more years, this aspect, I believe it is. Public Facilities Authority, Rashawn George, was sworn in. The Downtown Development Authority, Mr. Warren Washington has a business in the downtown area, frozen smokes, and Mr. Robert Anderson, who is the Downtown Development Authority Chair. And then, of course, our own judge, Judge McCormick. [0:39:54, 0:40:10]: McCord, Matt McCord was sworn in office as well. So that was all part of our ceremonial part of this. And so on that note, we would like to have the the youth council come forward to give their brief presentation about the entrepreneur expo that they have for us, please. [0:40:12, 0:40:27]: Good evening, Mayor and Council. Thank you so much for um fitting us into your agenda. I would like to um first um introduce Ms. Sharika Zales. She um just was re sworn in, so if you can come forward. [0:40:28, 0:40:48]: Um she's gonna stand with the youth. Um we think it's very important for the youth council since it's their program to to present to you all what their initiatives are. So that's why we're starting this today. So first we have the mayor pro temp, which is Miss Ari Hall. Then we have um Miss Gabriella and Dina. She is [0:40:48, 0:41:05]: the city city clerk and then we have Alejandra Holgate she is a member at large so if without further ado um they're gonna go ahead and get started with the presentation and miss Zellas she's gonna assist wherever is needed. She's a student she's our student liaison okay thank you very much [0:41:10, 0:41:10]: Yeah. [0:41:35, 0:41:55]: Good evening, Mayor and Council. I am Ari Hall, like she said. Um so we are here today to present to you our youth entrepreneurship expo proposal, and we are hoping to gain your support as well as um your approval so that we can have our first event because this is the first time we would be doing this and we [0:41:55, 0:42:02]: We want to do it to allow young entrepreneurs to be able to put their businesses out into the public. [0:42:06, 0:42:26]: Um, good evening once again. My name is Gabriella Andino. I'm going to be heading this event. Could you talk a little louder, please? Okay, sorry. Good evening. My name is Gabriela Andino. I'm going to be heading this event. And I just want to explain what our goals for this event are. Um, first and foremost, like Ari had mentioned, our goal for this event is to create a platform for young entrepreneurs. [0:42:26, 0:42:46]: Specifically under 21 to allow them to promote their businesses in the area. Additionally, we would like to have it be a community event as well. So we want to have things like the vendors, food trucks, entertainment, activities, DJs, music, and things of that sort. And additionally, we would like to use [0:42:46, 0:42:56]: this event as a way to promote and spread awareness for the Stockbridge Youth Council and use it as a type of recruitment for the 2024-2025 year. [0:42:58, 0:43:02]: Additionally, this event, more most importantly, will be [0:43:02, 0:43:16]: Um Saturday, March 30th from 12 to 4. And hopefully if we get you guys' approval, we would like to do it at Clark Park. And our target audience is the Stockbridge area and anybody else who would like to come out and support the youth. [0:43:17, 0:43:18]: Okay. [0:43:19, 0:43:37]: All right, hello, my name is Alejandra Holgate. Um, so we would like before we go over what we want from the council, we would like to extend an invitation for collaboration. So if any of you are interested in collaborating with the Youth Council for this event, we would gladly appreciate it. And we'd also appreciate the [0:43:38, 0:43:58]: Target audience that you would bring in addition to the ones that we have. So, what we need from the city, we would like to reserve Clark Park again on March 30th, 12 to 4. And two weeks before our event, we would like to use the banner display near Rock Quarry Road. We will also need tables and chairs. [0:43:58, 0:44:06]: To give to our vendors to set up their businesses. And then we'll also need assistance to set up and break down. [0:44:08, 0:44:10]: And that is it. Any questions? [0:44:11, 0:44:13]: All right. Mayor. Um go right ahead, please, Ms. Gapp. [0:44:14, 0:44:19]: Um great jobs presentating pr for your presentation. Thank you for that. What [0:44:19, 0:44:30]: Exactly. Um, will happen. What's your plan B, just in case, because clock prike is outside. Do you have a plan B? Um for another location or anything of that nature? Did you tell [0:44:32, 0:44:46]: Well, if we are if if I guess the weather does not permit at Clark Park, I I guess we need to kinda think about what are other venue options that we could use. We may have to rent a space because I know we don't have we've we've used the marrow. [0:44:47, 0:44:49]: Already for our Christmas event. [0:44:49, 0:44:53]: So I'm unsure if we'll be able to use that again'cause I think we get it twice a year. [0:44:53, 0:45:13]: But if not, we would probably like to see if we could use the Merrill as a secondary location in the event that the weather does not permit because that is that can accommodate the size. Okay. And that was gonna be my suggestion. Um if the Merrill is Merrill Manders is available, that I would suggest and ask Mayor and Council to approve that is plan B. [0:45:13, 0:45:16]: just in case they needed to shift it over. [0:45:16, 0:45:28]: Um, but I love the event as far as the entrepreneurship goes. I'm a small business owner myself. So I definitely will be supporting you guys in any way that I can. [0:45:28, 0:45:29]: Thank you. [0:45:30, 0:45:32]: Mr. Alzangoy, please. [0:45:32, 0:45:33]: Okay. [0:45:33, 0:45:39]: This is an awesome idea and I thank you all for bringing it forward. Which one are you all are entrepreneurs? [0:45:40, 0:45:55]: Absolutely. Well good. You're on board and we're fully supportive of what we need to do to kind of make this happen. We just need folks to understand that they need to pursue their dreams and that's what you guys are doing to trying to help young people pursue their dreams. So thank you. [0:45:56, 0:46:00]: Ms. Barbercoy, please. There are actually two banner displays. [0:46:00, 0:46:10]: One at the intersection of Rock Quarry and North Henry, and the other one is right in front of the Walmart on North Henry. Is there a reason why you're only wanting to use one? [0:46:11, 0:46:31]: Um, well, just because I know Mayor and Council already has a calendar that's already planned out. If we are able to use both marquees, that would be great. But in the event that because last time when we did the Christmas event, Councilman Thomas was also using the marquees and he was just gracious enough to let us use one. In the event that both of them are free. [0:46:31, 0:46:37]: we would love to use them for that two week period. But if we can't get both of them, we would at least like one. [0:46:39, 0:46:45]: I'm sure well the city clerks or the executive assistant to mayor and council should be able to check the calendar. [0:46:46, 0:46:47]: To see if there is something. [0:46:47, 0:46:49]: Um already planned. If not then [0:46:50, 0:47:10]: I support you all using both of them. Oh, that would be awesome. More exposure you get, the better it will be. Go ahead, please. That is a great idea to be able to use both of them. I think that second one in front of Walmart is in the construction zone where they're widening the highway at and they've taken down all the plants and everything. [0:47:10, 0:47:30]: Everything around it. So I'm not sure if it's if it's certainly if it's available, you certainly will be able to use it. But that but it's in the middle of the construction zone. Got it. Any comments on this side? Go ahead, please. Mr. I just want to echo what the uh council has already stated. I'm super excited about the project that you guys are putting on, and uh I throw my support towards you as well. If there's anything that you guys need to do, you can see that. [0:47:30, 0:47:44]: I I'm fully in support of it and I I I look forward to seeing the turnout and seeing how uh effective it will be. And I'll do everything in my power to help uh spread the word. Absolutely. Yes. Uh Mr. Thomas, go ahead, please. [0:47:44, 0:47:51]: As as always, anything that I could do to be of an assistance. And as you all know, if I have events going [0:47:52, 0:48:02]: You know, we we make it happen, we make it work. So uh we'll look at whatever conflict potentially there may be and we'll just work it out. But you have my full support. [0:48:03, 0:48:15]: Mayor. Yes, ma'am. I move that we approve the youth entreprene entrepreneurship expo um to be held on March thirtieth, twenty twenty four at Clark Park between twelve to four PM. [0:48:16, 0:48:25]: With the secondary with the secondary location, if available, being Merrmanders. Okay, sir. Second that motion all favor, please indicate. [0:48:26, 0:48:29]: Now it's decision. Thank you very much. I appreciate that, ladies. Appreciate it. [0:48:30, 0:48:50]: We'll be we'll be there. Sorry. I just wanted to mention really quickly, I just wanted to say to everybody here. Um uh we extend the invitation out to everybody to come out and to support the youth, as well as if you know any young entrepreneurs, please um reach out to us so we can give you guys the interest form so that we know that and we can reach. [0:48:50, 0:48:55]: out to them to have them at this event. Thank you. Thank you. Appreciate it. [0:49:01, 0:49:04]: All right, ladies and gentlemen, Council, what we have is public hearings this evening. [0:49:05, 0:49:11]: And so uh so public hearing rules are please mute all cell phones and other electronic devices. [0:49:12, 0:49:19]: If anybody wishes to speak tonight on a public hearing item, please fill out a form available on the table and hand it to the clerk before approaching the podium. [0:49:42, 0:49:48]: Each side will be allotted ten minutes total. Additional time may be extended at the discretion of the council. [0:49:49, 0:49:55]: Keep comments, please keep comments and presentation professional, referring only to the facts that are pertinent to the case. [0:49:56, 0:50:16]: We will not allow comments or personal attacks toward any individual group. Please refrain from applause or comments from the audience during the public hearing. [0:50:36, 0:50:51]: Other than the applicant, no person may speak more than once. The applicant may reserve part of it or his or her speaking time as a rebuttal and may speak next and last and maybe use the entire 10 minutes allowed for the pro side of the application. [0:50:51, 0:50:57]: If questions are raised, the council may ask the applicant to address questions or and or concerns. [0:50:58, 0:51:01]: The provide provided who excuse me, providing officer [0:51:01, 0:51:04]: shall call for a motion and a second to the motion. [0:51:04, 0:51:12]: And have any necessary discussion. If the matter is not tabled, the presiding officer will call for a vote to rec uh to recommend approval or denial of the request. [0:51:15, 0:51:26]: So our first public hearing, um Copper has a planned amendment case CP two zero two three-08 located in council district four. [0:51:27, 0:51:47]: And now there's several of the things I'm gonna read here, and we'll have uh one go at this, but uh consideration to request a uh comprehensive plan amendment to change the future land use designation of a certain property at 135 and 305 East Atlanta Road from low density mixed use to special purpose to allow for construction of the townhome. Once again, one thirty five East Atlanta Road parcel S twenty five das zero one zero two two zero zero zero contains one point two eight plus acres and three oh five East Atlanta Road parcel S twenty five das zero one zero two two zero five excuse me zero. [0:52:27, 0:52:47]: Contains.37 acres. Also, what was happening with this these parcels would be the rezoning case. RZ-2023-09, once again located in Council District 4. Also involved with this case would be a variance case, VR 2023-0. [0:53:27, 0:53:47]: Once again, Council District 4. Consideration of three variances for a certain property at 135 and 305 East Atlanta Road to allow for construction of a town hall development. Okay, thank you. Okay. [0:54:50, 0:55:00]: Here's a vicinity map of the proposed development in relations to the other recently approved developments near or around downtown. [0:55:03, 0:55:13]: Here's our aerial photo of the site, the two properties, 135 East Atlanta Road and 35 305 East Atlanta Road. This is the aerial photo of the site. [0:55:14, 0:55:22]: Here's a aerial photo with the site plan. Uh Ms. Ryan, just in case. I mean, could you talk with a mic to make sure everybody hears you properly, sir? Appreciate it. [0:55:22, 0:55:22]: Okay. [0:55:24, 0:55:27]: Okay, here's a I have to be now. Here's a aerial photo with the site plan. [0:55:34, 0:55:36]: Uh here's the um existing house that is [0:55:37, 0:55:43]: Here's the existing home that's located on the property. Uh, and also proof of our zoning advertising sign. [0:55:47, 0:55:57]: Here is the church um church at Stockbridge and um the printing T DK designs. Um [0:56:00, 0:56:14]: The applicant is requesting to be to go from low density mixed use to special purpose. Special purpose is our new newest land use designation that was recently adopted in our twenty twenty four comprehensive plan update that was approved by council unanimously. [0:56:18, 0:56:22]: And here's the definition of of the special purpose land use ca um designation. [0:56:24, 0:56:40]: This designation has uh I'll read the definition. This des designation has been developed to allow for special per special innovative project with which could include anything from different model residential to larger mixed use or commercial development. All zoning is appropriate. [0:56:40, 0:56:51]: The density is sixteen point oh one acres to twenty four units per acre. Here's the joint zoning map and the land use map. [0:56:58, 0:57:00]: Here's another map of the overlay district. [0:57:05, 0:57:07]: And this is the joint future land use map. [0:57:10, 0:57:17]: Uh the surrounding zoning. To the north of the property you have uh single family residence residential. [0:57:19, 0:57:36]: with low density mixed use land use designation. To the south, you have the Watch Me Growth, Toddlerville Daycare Center. And the downtown district is the land use category. Property to the east of the subject properties, you have single family residential and you have low density mixed use. [0:57:36, 0:57:45]: Property to the west, you got the church at Stock Bridge and existing single family residence. The land use categories medium density residential and downtown district. [0:57:48, 0:57:50]: The surrounding land used densities. [0:57:50, 0:58:10]: Spanish village, one unit uh 28 units. The Hall sub Hall Dival subdivision, they have 28 units. Diamante Townhomes, they have 200 units. And DR Horton Townhomes, they have 165 units. Diamante Townhomes and D.R. Horton [0:58:10, 0:58:13]: Townhomes that were recently approved within the last two years. [0:58:22, 0:58:41]: The City of Stockbridge comprehensive plan states that the future land use designation of special purpose is for properties with sixteen to twenty-four units per acre. This proposed townhome development has a density of sixteen units per per acre, so it is consistent with the proposed land use category in which they seek. [0:58:44, 0:59:04]: The staff report has demonstrated that the requested comprehensive plan amendment via CP 202308 would be necessary and desirable for the subject property in conjunction with the requested zoning of RZ 2023 to change the the zoning district from SR to MFR with the approved variant. [0:59:04, 0:59:05]: [3546.5, 3562.1]: Therefore staff recommend approval. Uh I misspoke. This is strictly for the complaint. Staff recommends approval for the um for the complaint. Now I'll move along to the rezoning. Stand by please. Any questions for Mr. Ryan on this uh on the comprehensive plan right now, Council? [0:59:23, 0:59:24]: Any questions? [0:59:25, 0:59:26]: Um [0:59:27, 0:59:30]: Does Barber you have a question? Yes, my question is. [0:59:30, 0:59:38]: So will we allow public comment? Yeah, you have you have of course at this point. Yep. Can I finish? Go ahead. [0:59:39, 0:59:49]: He's about to begin discussing the rezoning. That's correct. I want to make sure that we address each of these items separately. [0:59:49, 0:59:50]: As we have been [0:59:52, 1:00:08]: Well actually actually the last time we did this we we we read every everything associated with a particular um action and then we we we voted separately but uh everybody came up with talk we was able to give comments on whatever item they need to talk uh talk on, whether it's rezoning or annexation in or whatever the place may be. [1:00:09, 1:00:10]: That's the last time we did this. [1:00:11, 1:00:22]: That's what happened last time. Um it just seems as though whenever there are proposals presented for city council district four, the rules change. No. So I just want to be consistent with what we're doing. That's all. [1:00:23, 1:00:28]: Okay. Thank you for that. Appreciate it. Any other questions right now, Council, in reference to comprehensive plan? [1:00:30, 1:00:31]: Yes, sir. [1:00:33, 1:00:39]: Uh you mentioned uh the setback. Can you um [1:00:39, 1:00:59]: detail that a little bit more what that represent. I just want to make sure that uh everyone understands uh what that actually is in in real time and how it's going to actually affect uh the area and and especially uh the streets. Okay, council member Thomas do you do you mind if I uh wait to get that [1:00:59, 1:01:19]: Until I get to the variance portion. Okay. It'll be coming up right after this section right here. Okay, good. So I can stay in line. Okay. All right. I've okay. No the question from counsel, then we'll move on and you're gonna talk about the variance now. Is that what it is, sir? No, the rezoning. Rezoning's next. Go ahead, please. Uh the applicant is requesting from uh rezoning from suburban residential to MFR or multifamily residential. [1:01:19, 1:01:23]: residential to allow for the construction of a town home development. [1:01:29, 1:01:32]: Here's a copy of the zoning map. [1:01:35, 1:01:43]: And here's um the site plan, the 1.28 acre site and the 0.37 acre site. [1:01:45, 1:01:48]: Here's the conceptual site plan right here. [1:01:55, 1:01:57]: The development data for the site plan. [1:01:59, 1:02:00]: It will consist of [1:02:01, 1:02:21]: 13 buildings. Building one through seven, building the housing units one through seven will contain seven thousand square feet. Building that will house units eight through thirteen will contain six thousand square feet. Building four building number three that will house units fourteen through twenty will have seven thousand square feet. [1:02:21, 1:02:27]: twenty one building four that would house units twenty one through twenty seven will contain seventy nine hundred square feet. [1:02:30, 1:02:35]: Here's a rendering of the an elevation of the of the proposed townhomes. [1:02:45, 1:02:56]: This project is also part of the of a of a approved LCI study that was approved by city council. Um and this property is in the Grope Center area of downtown. [1:02:58, 1:03:00]: And the property's located in this bubble right here. [1:03:02, 1:03:03]: Where the arrow is pointing. [1:03:07, 1:03:16]: Um right here is the samples of some town homes of in other municipalities that are closely related to what the applicant is proposing. [1:03:18, 1:03:24]: You can see that the um the lot lines are real the front yard setbacks are real close to the streets. [1:03:28, 1:03:48]: Uh the the project a brief project description. The applicant is proposing to build a twenty-seven unit townhome development at a density of sixteen units per acre uh with within the special purpose land use category. The special purpose land use category allows up to twenty-four units per acre. So the site is compatible with the proposed. [1:03:48, 1:03:54]: Comp plan and land use designation. Um staff analysis. [1:03:56, 1:03:58]: The applicant has requested a change [1:03:59, 1:04:00]: The future land use. [1:04:02, 1:04:02]: Wait a minute. [1:04:03, 1:04:04]: The development of this site [1:04:06, 1:04:11]: as the townhome meets the overall purpose and intent of the Stockbridge Unified Development Code. [1:04:12, 1:04:32]: Section 1.4 provides a list of objectives to accomp which are to accomplish, which lists as follows. A. Prosperity, general welfare of the present and future residents of Stockbridge, encourage the most appropriate and best use of land, buildings, and other structures. This development is consistent with the purpose of that of the MFR zoning. [1:04:32, 1:04:45]: Section 2.44 of the Stockbridge Unified Development Code state that the intent and purpose of the MFR district is to allow the development of multifamily residences served by public water and sewer systems. [1:04:51, 1:05:11]: The relation that the proposed rezoning amendment bears to the purpose of the overall zoning scheme with due consideration given to whether or not the proposed change will help carry out the purpose of the City of Stockbridge zoning code. This project does that. It is consistent with the city's comprehensive plan and it's consistent with the unified development code of [1:05:11, 1:05:12]: [3916.9, 3925.0]: The requested rezoning from SR to MFR will be very beneficial to the downtown area of the city of Stockbridge in a in a variety of ways. [1:05:25, 1:05:33]: While other areas in the city have seen residential growth over the past couple of years, the downtown area lacks modern residential developments. [1:05:33, 1:05:37]: There are several studies that were endorsed by the city council that encourages um [1:05:38, 1:05:40]: Development downtown, the Georgia Tech study. [1:05:40, 1:05:45]: And the LCI study and our downtown master plan all calls for increased development downtown. [1:05:49, 1:05:53]: And also this project is located within the tax allocation district of the city of Stockbridge. [1:05:56, 1:06:06]: Uh the result of of staff's findings and conclusions is that staff recommends um approval of the rezoning. Also the Planning Commission recommended approval. [1:06:08, 1:06:16]: Okay, any questions thus far council in reference to the rezoning case? Yes, ma'am. Mr. Thomas I had a question. [1:06:16, 1:06:35]: I think that was on various, I thought. Of course. Okay. Okay. Anybody this end? Any questions for Mr. Anderson? On both items. Well well if you want both items, you already heard the one. I just wanted to make sure we were there. Okay, as it refers to uh this particular development, let's look at the setbacks. [1:06:37, 1:06:50]: Yeah, we'll we'll get to setbacks that finish the Baron's presentation. Okay. We haven't got to the Baroness yet. Just coming next. So we do have some uh as the recommendation, staff recommendation, we do have some con conditions. [1:06:50, 1:06:56]: Conditions of approval. Okay, go write it, please. Uh the first one is the ten foot sidewalk shall be established across the furniture. [1:06:56, 1:07:00]: The proposed development shall include all two car garages. [1:07:00, 1:07:17]: The proposed townhomes shall be constructed according to a design which is similar to the one that is shown in the applicant's submitted site plan. The project will be in conformance with the City of Stockbridge Unified Development Code and all other city codes regarding the site development standards and other requirements that are found. [1:07:18, 1:07:23]: and the townhomes shall be comprised of brick, stone, cement based siding, or shake siding. [1:07:23, 1:07:25]: Those those are the five conditions of approval. [1:07:26, 1:07:26]: Okay. [1:07:28, 1:07:39]: Yes, ma'am. Go ahead please. Can you add flock cameras at the entrance of the of the um for that purpose? Yes, yes. At the entrances, thank you. Okay. [1:07:41, 1:08:01]: Okay, and I do have one question. Go ahead, please. Uh in regards to the the ten foot sidewalk. The ten foot sidewalk is a r along the entire frontage, correct? Yes. Okay, and that is that is not included in the setback. No. Okay. So it's been whatever that is, so there'll be [1:08:01, 1:08:06]: We have ten foot sidewalk in addition to whatever the setback was. Yes, sir. That's correct. Okay, thank you. [1:08:08, 1:08:28]: Okay. No other questions thus far? All right, so I guess going to the variance sir in various case. Yes. Uh the applicant is requesting three variances. You want to reduce the front yard setback from fifty from fifty feet to fifteen feet, reduce the required side yard setback from fifteen feet to ten feet, increase the max the allowable maximum lock coverages. [1:08:28, 1:08:31]: From fifty percent to sixty percent. [1:08:32, 1:08:50]: Um the first variance request is not is not an unusual variance request in a downtown district or downtown area. And most munici municipalities if you drive downtown, most of their new projects have zero front yard setbacks. I mean uh a development comes right up into the um into the sidewalk. [1:08:54, 1:09:08]: So here's the MFR district standards. The front yard setback requirement is 50 feet. Applicant request is 15. The side yard setback is 15 feet. The applicant is requesting 10. The maximum lock coverage is 50. The applicant wants to do 60. [1:09:11, 1:09:22]: Um the first criteria that the applicant meets as as far as it relates to a um a variance is that the property is exceptionally small, unusually small. [1:09:25, 1:09:39]: And a literal interpretation of the of the provision of the unified development code would deprive the applicants of rights commonly enjoyed by owners of other properties located in the zoning districts. So he meets that criteria. The applicant meets that criteria. [1:09:43, 1:09:51]: Granting of variance requested will not confer upon the property owner any special privileges that are denied to other owners of property in the same zoning district. [1:09:51, 1:09:56]: Granting the request environments would not confer any special privileges upon the the property owner. [1:09:56, 1:09:59]: So he meets criteria number four. Criteria number [1:10:00, 1:10:20]: It meets criteria number three. Criterion number four, the variance will be consistent with the purpose and intent of the unified development code, will be compatible with uses on neighboring properties, and will serve the public welfare. The requested variance would be consistent with the overall purpose and intent of the unified development code by encouraging the most appropriate land use on the subject property. Furthermore, [1:10:20, 1:10:40]: More granular granular variants would allow the growth the development of the subject property in an area which is not seen a lack of residential development. The proposed townhome would be a desirable use in this area. In addition, the reduction of the front yard setback from fifty feet to fifteen feet would be advantageous since the proposed town [1:10:40, 1:10:48]: Homes are located in the downtown area and will provide walking distance for the from the units to the amphitheater and other downtown amenities. [1:10:52, 1:11:12]: Uh criteria number six, I mean number five, the extraordinary circumstances are not the result of the actions by the applicant. The physical conditions of the subject property were not created by the applicant. However, it is limiting limiting the ability of the applicant to develop the property into a reasonable use, which is the propo proposed Tyrone Homes. [1:11:11, 1:11:30]: applicant meets criteria number five. The variance is the minimum relief that would allow the legal use of the land, building, or structure. Although the subject property could still be developed with townhomes under the proposed MFR zoning district, the developer would not be able to move forward with the proposed development as requested. [1:11:30, 1:11:32]: Criteria number seven. [1:11:32, 1:11:48]: The variance is not a request to permit the use of land, buildings, or structure structures that is prohibited in the same zoning district. The MFR zoning district provides a list of permitted uses and townhomes are included on that list of permitted uses. [1:11:53, 1:11:55]: Samples of our townhomes fronting the street. [1:11:57, 1:11:59]: You can see the smile front yard set back. [1:12:03, 1:12:08]: Since the applicant met all the criteria for a zoning, staff recommend approval. [1:12:10, 1:12:14]: All right. Mr um Thomas, you have some questions. I believe the Varance here. [1:12:15, 1:12:16]: Thank you, Mayor. Um [1:12:17, 1:12:21]: I I wanted to get into a conversation about the setback. Um [1:12:21, 1:12:23]: And I was just reading here. [1:12:24, 1:12:27]: And and and just let me say it this way if I may. [1:12:27, 1:12:28]: Um [1:12:31, 1:12:33]: You know, i in our training [1:12:34, 1:12:38]: And just recently we visited a city. [1:12:38, 1:12:53]: And we sort of we saw a lot of developments that were very close to the street and y and you sort of just mention that. But what I try to do um when developments come to me as a elected official [1:12:55, 1:12:57]: I I try to make sure that [1:12:58, 1:13:00]: These things fit into [1:13:00, 1:13:02]: The overall [1:13:03, 1:13:18]: concept that we have laid out, such as the comprehensive um plan, the unified development code, the land use code, the pr you know, the L CI. So I I just try to make sure that [1:13:19, 1:13:20]: We [1:13:20, 1:13:22]: А за муніципаліті [1:13:23, 1:13:25]: Set that bar. Set that. [1:13:25, 1:13:27]: And so when developers come [1:13:28, 1:13:30]: They conform to [1:13:31, 1:13:41]: the vision that we have as as a city as far as land use, how we wanna see different areas grow and develop, as opposed to [1:13:42, 1:13:50]: The municipality conforming to developers. Cause I've seen now that over the years, [1:13:50, 1:14:01]: the developers come and we we go as developers come. And that just you know my basic concern about this whole process. But [1:14:01, 1:14:03]: The the whole set back [1:14:04, 1:14:07]: And I just want the citizen to know that we have seen [1:14:08, 1:14:17]: Um business is very close to the street now, even though personally I have a problem with that, but I do understand that. So [1:14:17, 1:14:19]: Speak to [1:14:19, 1:14:23]: the setback and in real time and [1:14:24, 1:14:34]: the vision and how that look and and maybe even the nutrient. You alluded it you alluded to it in your presentation, but could you just sort of speak to that a little bit more? [1:14:35, 1:14:43]: Yes, sir. Uh we as staff we take all information that is presented to us and we contrast that information against all our approved plans. [1:14:44, 1:14:46]: Uh all out the approved code. [1:14:47, 1:14:56]: which includes the zoning ordinance and the comp plan and we come up with an analysis and uh the pro the applicant's proposed the applicant's proposal [1:14:56, 1:15:01]: met all the requirements. Um the Georgia the Georgia Tech study, the LCI study. [1:15:02, 1:15:22]: The um bicycle pedestrian study um is comparable with our is comparable with our recently adopted comprehensive plan, which we recently adopted in October 2023 with the special purpose land use designation. The special purpose land use designation was a creative um is a [1:15:22, 1:15:36]: is a land use category that's designed to provide the provision for small lot development downtown with developments close to the street to encourage walkability. And um that's what this project does. It encourages walkability. [1:15:36, 1:15:40]: In line with the Georgia Tech study, in line with the downtown master plan. [1:15:40, 1:15:41]: In line with the um [1:15:42, 1:15:43]: What is it [1:15:43, 1:15:45]: Well that's the Georgia Tech studied um the [1:15:45, 1:15:55]: the downtown master plan and the LCI studies which were all endorsed by the city council. So staff we've we've taken all that information and like I said, we've contrasted it. [1:15:55, 1:16:11]: And we went in depth did an in-depth analysis to make sure that this project is consistent with the city's vision. Not only is it con incons consistent with the city's vision, it's consistent with our with our existing documents that we have, with our with our unified development code and our comprehensive plan. [1:16:11, 1:16:27]: Right. And and I know you you mentioned the fact that we approved a mixed use special purpose. And and and and originally I had a concern because it says the applicant has requested [1:16:28, 1:16:30]: А компрессив план аменмент. [1:16:31, 1:16:33]: To change the [1:16:33, 1:16:49]: the future land use designation from the existing. So see when I when I read those kind of things, this is where I I I become a little concerned about an applicant. [1:16:49, 1:17:05]: asked in the municipality to to make those changes. But you explained it well enough that I understand that uh we approved a different kind of mixed use that would allow for [1:17:06, 1:17:12]: that future, if you will. A and I I sort of get that, but but that just really my contention about [1:17:13, 1:17:31]: You know, when we when we put the work in, set the vision out there and and try to go and make sure that things that come to us is in the scope of the vision that we have laid out as opposed to every time a developer come. [1:17:31, 1:17:41]: We're changing our land use, we're changing our comprehensive plan, we're changing, we're changing, we're changing. But that just just just my concern and I guess at the end [1:17:41, 1:17:46]: You know, a well developed area, well developed city. I I I get that, but [1:17:47, 1:17:53]: I I just just my concern. But Mayor, I thank you for that and I thank you for your response and and and I yield. [1:17:53, 1:17:58]: No problem. Any other questions for Mr uh Anderson right now? Yeah, if I could [1:17:59, 1:18:19]: Uh certainly uh there was some I think as we looked at we saw the def the the um display of what the setbacks will look like. Now the request is for a fifteen feet setback. That's from the property line, correct? Yes, sir. So that will not include the sidewalk. No, sir. So it in it those [1:18:19, 1:18:32]: pictures right there are actually probably closer than this development would be to the street because you would have the 10 foot sidewalk, then you'd have an additional 15 feet between the property line and the sidewalk. [1:18:32, 1:18:52]: Yes, sir. It would either be it would even be further back. Uh these are just examples and illustrations. Right. I just want to make sure that that we're clear that they won't be that close. There'll actually be the the side of just rough scale, ten foot sidewalk, fifteen feet, maybe a little bit more than that, but a minimum of about twenty five feet away from the street, which is [1:18:52, 1:19:10]: further than what you would see right there. But what we did was uh when we passed the Highway 138 overlay plan, we passed this exam this same uh these standards to have a more modern feel to bring those properties closer to the street. [1:19:10, 1:19:23]: And then the parking would which would obscure the parking, so the parking would be in the rear of the building and you would not come up on a development and look at the back of cars or all of this uh just a parking lot. [1:19:24, 1:19:44]: Yes, that's correct. And that that's the um the new trend and um and small lot development that you see in most of the um sm s towns or cities the size of Stockbridge. Like you go to Hapeville, you can see that they have their uh townhomes, their new townhomes developed real close to this to the street. With uh some of them have a zero front yard set back. [1:19:44, 1:19:45]: Back door right on the sidewalk. [1:19:45, 1:20:05]: Okay, as a DDA board member, there was an opportunity where the DDA, the downtown development authority, actually commissioned the market study by Georgia Tech. Are you familiar with that? Yes, sir. Okay, that study was uh it showed pretty much the downtown area footprint. And what it also did was establish that [1:20:05, 1:20:21]: we had quite a significant shortage of housing in the downtown. Is that correct? Yes, sir. The study was done in twenty twenty two and it stated by twenty twenty seven that Stockbridge needed um eight hundred additional units and by um twenty f let's see, uh twenty um [1:20:23, 1:20:24]: And by the year [1:20:26, 1:20:30]: Twenty twenty forty we'll need seventeen hundred new replacement units. [1:20:31, 1:20:51]: Right, and that's just to keep up with uh the current trends. But as we know, the current trends are actually there's actually growing, right? Yes. So I think ARC has told us mil you know, I think five thousand people were added to Henry County last year and in the Metro Atlanta area we're expecting several million more people to be moving here. So you [1:20:50, 1:21:10]: Tell them all we're closed, they're still coming. They're not stopping to come. So that's kind of where we are now. But uh that study was very detailed in what uh the requirements uh were for the downtown, and it stated several things as such as we needed the additional housing, and also stated we needed quality housing in [1:21:10, 1:21:21]: in downtown as it stated, which will shock everybody that's listening. The average age of the home in downtown Stockbridge was built in nineteen sixty-six. [1:21:22, 1:21:42]: I said that right. The average home in the downtown Stockbridge area was built in nineteen sixty-six. So that is where we stand today as uh the housing need in the community has certainly been established by this Georgia Tech study. And certainly we want to make sure that we do what's appropriate for the community. [1:21:42, 1:21:51]: Hear from the community and what they have to think about it, and to understand that you know, I I just say this to the community. [1:21:52, 1:22:12]: And I say this in earnestly because it applies to me. As a grandparent, I want to see my grandkids grow up. I want to see my granddaughter grow up. This is the type of development that those that the kids are moving to. There was a study done several years ago that asked, you know, our kids, you know, when you grow up post-college, would you [1:22:12, 1:22:32]: Return to Henry County, the overwhelming majority said no, because there was not anything for them to do and the type of housing that they desire. I like a yard. The young kids, they don't really like that. They like the low maintenance. They don't want to mow lawns. They don't want to do any of that. They just want a nice house that they can move into and that's uh um [1:22:32, 1:22:52]: got nice appointments in it, but they don't want to do the maintenance. And this is the type of development that they have. So if I want to see my granddaughter grow up and my daughter buy a home in this community, because a single family home now starts at$350,000. That's what they start at. Young kids getting out of college, they can't afford that. [1:22:52, 1:23:12]: And understanding where we are today is that um as they grow and matriculate through the system, they might start out with an apartment like most of us did. There will be a gap between that single family home and then um uh any type of town homes. But understanding, and I try to get folks to understand this as I close when [1:23:12, 1:23:12]: Mm-hmm. [1:23:12, 1:23:32]: The the town homes that uh we passed in our new comprehensive plan, they're essentially sing uh attached single family homes. Were it not for the fact that they were attached, there would be pretty much indistinguishable between what we see in a single family home. Is that correct? Yes, the quality, yes. Mm-hmm. Absolutely. Thank you. [1:23:33, 1:23:45]: All right. Any other comments from the council thus far? If not, I was just wondering about the applicant. Um uh Harold R. Singer, uh from that consulting group, if they wanted to come forward, they got anything uh additional to add before I open up the public hearing? [1:23:46, 1:23:46]: Yes. [1:23:54, 1:23:54]: Ryan. [1:24:02, 1:24:16]: Good evening. My name is Harold Singer. Uh my address is forty thirty four Lionsgate, Douglasville, Georgia, three zero one three five. Uh thank you for the opportunity to speak to you this evening. If you give me one second to love my presentation. Sure. [1:24:22, 1:24:35]: Yeah, pass it along. Yeah, you you just had it down. [1:24:36, 1:24:40]: Yeah. I just wanted to make sure you understood it was here. [1:25:33, 1:25:53]: Uh as I stated, my name is Harold Singer. Um one of the uh the owner of the property, uh Mr. Reggie Sylvane is a well-known business owner in the city of Stockbridge and uh the metro area. He is the one that initiated this project, and primarily based on what was said tonight, that the desire to bring [1:25:53, 1:26:13]: Some diversity and some modern housing to uh downtown Stockbridge. In that effort, he has partnered with two developers, Derek Harris and Celine Morrissey, between the two of them. They have 30 years of development experience. Um, some of the details of the uh development have [1:26:13, 1:26:20]: I've been already spoken, but I'll go over it. It's 135 and 305 East Atlanta. It's actually an assemblage of two lots. [1:26:20, 1:26:40]: We were directed by staff and communication with the submission of our various applications to go from SR suburban residential to multifamily uh residential. We're proposing 27 three-story town homes. Um, to do that requires a rezoning, a land use amendment, and the [1:26:40, 1:26:50]: three variances that were were discussed. Uh this is a a site plan uh that was submitted with our our application. [1:26:50, 1:27:10]: And here are some renderings. I I wanna kinda spend a little time on this because part of the conditions that were uh laid out by staff was that the siding would be brick and cementus. These are elevations um that indicate that those are in fact the material. [1:27:10, 1:27:15]: materials that we would plan on using, brick and cemented siding. [1:27:15, 1:27:23]: Um later on I'll give some examples of the work of the developers to kind of give you a better feel of the uh quality of work. [1:27:24, 1:27:30]: Here is some elevations. This would be the entry point um for the development. Um [1:27:31, 1:27:46]: make note as it to the conditions they wanted two car garages um with we have two car garages so this is a side elevation i want to then let me see transition here [1:28:05, 1:28:11]: So here's some examples of the quality of craftsmanship and work done by [1:28:11, 1:28:16]: Mr. Derek Selene Derek Harris and Celine Morrissey. Let's see. [1:28:18, 1:28:32]: This was an example of some of the finished materials that you would see on the inside of the the town home. You got the quartz countertop, you got the high-end flooring, uh backsplashes, hardware on the cabinets. [1:28:40, 1:29:00]: So this is just a small sampling of some of the work that they have done. Um and now I'll transition from this part to some of the feedback we we got from the planning uh uh session that was spoken about earlier. At that time, the uh community brought forward very [1:29:00, 1:29:10]: Various concerns about the development. The first I'll I'll tackle is the uh the HOA. We will uh [1:29:10, 1:29:30]: prepare and submit an HOA to this the body for UAL's review and approval prior to, but in that O HOA, it would directly uh address some of the s the community's concerns about trash pickup. There won't be any trash pickup until no earlier than eight AM. Um [1:29:30, 1:29:40]: There'll be strong language about how the residents are about to to handle their pets. There also um there was a concern about [1:29:40, 1:29:53]: Um the HOA being funded and being able to handle any uh improvements as the development went along, the HIA will be fully funded prior to being transferred over to [1:29:53, 1:30:13]: The residents, um, there was also some talk about a buffer between the adjacent properties. Um we plan on doing uh species plannings, probab maybe even a fence um to create somewhat of a buffer between the two adjacent properties. Um and the 10 foot sidewalk that is [1:30:13, 1:30:33]: Is um in the plans and already part on a sub uh being added to our site plan. And then that kind of goes to our variants. Um in addition to this being a very small lot, of which the staff brought uh I'm grateful the staff brought that to you all's attention. Is you know, we couldn't do anything about that. It's already an [1:30:33, 1:30:53]: assemblage, any effort to uh uh acquire or add the adjacent lots heretofore at this point have not been borne any fruit. So if we want to develop we're we're uh forced to develop the land that we have and it's this you know 1.65 acre site. So you know [1:30:53, 1:31:03]: So based on what we wanna bring, the kind of density and and the development that we need and quite frankly, the number of units to make this be a viable [1:31:03, 1:31:23]: project requires that we have the density that we propose. And in addition to the density, uh we just feel like that's kind of what the modern development is. Closer to the street, the 10 foot sidewalk is something we wanted to do anyway. It adds to the walkability of the the community. [1:31:23, 1:31:35]: So those were things that we were planning on doing. I failed to mention earlier we've were in communication with GFL to then be the company to do the trash pickup. [1:31:36, 1:31:56]: Uh and you know, we're negotiating with them to honor the hours and the dates and times of those pickups. So, you know, we're here, we we feel like um Mr. Favane has sold us on the City of Stock Bridge. We think it's a it's a great place. We think this development will be an addition to the city of Stock Bridge. [1:31:56, 1:32:16]: And bring some diversity and some modern housing and attract the target audience that was that was spoken about earlier. Young professionals either transitioning from apartment living to housing or young professionals that want to make Stockbridge their home and you know don't want to [1:32:16, 1:32:29]: deal with yards and things of that nature. So uh with that I'll yield uh my time and we appreciate the audience before you all this evening. Stand by sir. Any questions from Mr. Singer, Council? Any questions at all? [1:32:30, 1:32:50]: Okay, if you know questions and thank you, sir. I'm I'm pretty sure we'll probably hear from you again in a little bit. Absolutely. All right, on that note, ladies and gentlemen, we'll open up the public hearing. All right, I already read the public hearing rules. So let's let's do it this way. In favor. Anyone in favor of this development? Favor of this want to speak, right? I'm far, far left. If anybody's in favor, I'm far left. [1:32:50, 1:33:02]: left and leave for you to line up on line up on that side. You can stand up line right by the edge of the uh the counter there or the the top there line up and it will get you all lined up and ready to go. Anybody else in favor? Okay, from this my left side. [1:33:03, 1:33:05]: Anybody in the middle in favor? Wanting comments in favor? [1:33:06, 1:33:09]: In favor. Yes, please line up behind this lady over here, please. In favor. [1:33:10, 1:33:11]: Light up behind the lady over here, please. [1:33:11, 1:33:13]: Anybody else in the middle? In favor? [1:33:14, 1:33:15]: Line up line up on the side. [1:33:16, 1:33:19]: Anybody from my far right in favor? Anybody over here in favor? [1:33:20, 1:33:22]: In favor. All right. [1:33:25, 1:33:33]: Okay, Madam Clerk, uh when the first person speaks, start the clock and we'll go from there. Ma'am, you can come forward to Mike and give your name and address and and uh your comments, please. [1:33:35, 1:33:55]: Hi, I'm Latanya McGriggs. Um, my address is 4791 North Henry Boulevard. Um, Honorable Mayor, City Councilman, and esteemed guests, um, thanks for having me. Um, I'm in favor because the downtown um city of Stockbridge needs density. I've been doing real estate for [1:33:55, 1:34:15]: For 29 years, I'm the owner of Van and Roche Realtors. And I've just never in I just never experienced to where you have one developer that wants to come in and help the city build an entire city. That's just not heard of. So, Mr. Savannah, I appreciate you for that. Mr. Savannah has purchased six properties from us in the downtown. [1:34:15, 1:34:35]: area and prior to purchasing the properties from us he had already obtained some properties here in downtown um in downtown stockbridge so with that being said um for me doing my research I noticed that Henry I mean the city of Stockbridge is further behind even though it's the biggest city um in Henry County it's [1:34:35, 1:34:45]: the biggest city, but they further behind as far as development and density. So with that being said, I 100% approve. I mean I you know I'm in agreement with this project. [1:34:46, 1:34:47]: Thank you very much. Appreciate it. [1:34:48, 1:34:50]: Uh next sir, please. Name and address. [1:34:53, 1:35:13]: Good good evening. Nathan Banks. I'm recently uh a owner well partner owner at um Frozen Smoke. And I say this now that I have a vested interest on what's happening right on down downtown. Just to echo off of Miss Ms. Mc McGriff. That's are the things that we need right in the the [1:35:13, 1:35:24]: community. We need the walkability of folks coming downtown, middle class field coming down downtown and embracing and enjoying what we have downtown. [1:35:24, 1:35:44]: The mayor always says we are the city that connects, but it starts at the heart, and the heart and the pulse is downtown. So if we have a flourish downtown, that shows what the city is all about. So I'm in concurrence with this project, and I'm hoping to see many, many more that folks can come and see. [1:35:44, 1:35:53]: See the likeness of what we have here in Stockbridge and take us into the next century for our kids. Thank you. Thank you, sir. Appreciate it. Next gentleman, please. [1:35:56, 1:35:57]: Name and address. [1:36:00, 1:36:10]: this a little bit. Okay. Good evening council, mayor. Uh my name's Antoine Cloud. Um address 859 Chipmore Drive. [1:36:10, 1:36:30]: And uh basically I'm here because I support this project as well. Um my credentials is or is that I am a Stockbridge residence uh as well as a longtime Henry County resident. So I've seen the likes of McDonough, Hampton, [1:36:30, 1:36:50]: And places thereof grow. Their downtown areas have grown significantly, uh, residential-wise, business-wise. And so a lot of things took place, such as rezoning, things that we're looking at today. So um, Stockbridge is no different in what they need as far as rezoning and bringing business. So [1:36:49, 1:37:09]: So I support this project for that, as well as as Council Alexander said, the average home in downtown Stockbridge is from 1966, I believe you said. So let's just face the facts. Downtown Stockbridge is old. [1:37:09, 1:37:29]: And we need projects like this to continue the growth and to modernize the city of Stockbridge. So this council has done a great job from what I've seen with the city of Stockbridge, but there's more that needs to be done. And we need to approve projects like this to go. [1:37:29, 1:37:47]: Go that route. So um in conclusion, once again as a resident, as a homeowner in the city of Stockbridge, I support this and I have faith that the council will support this as well. Um thank you all for the job you've done and you will do in the future. Thank you. Thank you, sir. Appreciate it. Next gentleman, please. [1:37:52, 1:38:00]: Good evening, Mayor and Council. My name is Nick Armstead. Uh address is 807 Chelsea Wood Court in Stockbridge. [1:38:02, 1:38:06]: Piggybacking off of what mister Antoine Cloud just said, uh [1:38:06, 1:38:12]: I would have been the resident to move into this type of uh development. [1:38:12, 1:38:32]: I recently, well, I'm a long-term Henry County uh resident, but I recently moved to Stockbridge from Rex area. This would have been my next move, you know, had this been available. Uh just speaking, you know, to the age of the homes, I'm also an interior designer and I can speak to that directly. And a lot of the homes that are in Stockbridge. [1:38:32, 1:38:50]: Bridge area are well outdated. Um so this would have been something that would have been my next move had I not found my uh place in the eight o uh eight oh seven Chelsea Wood Court. But I'm all in support of uh of a development like this and you know I think that we need a lot more, you know, of this going forward. So [1:38:51, 1:39:05]: Thank you, sir. Appreciate it. Yes, sir. Okay. That was anybody for approval. Now people that are disapproved or have any negative comments about this development. Need for the uh from the very left side. In the left side, line up on that side. And the later left side, any negative comments? [1:39:05, 1:39:06]: Anything that you [1:39:06, 1:39:24]: Wanna say just right there be fine, sir. Right, okay. Anybody in the middle that ha that disapproves of this particular development, that wanna have some comments. Okay, anybody on on my far right that has any comments that dis to disapprove this? If you do, come on come on line up on the side please. With this other behind this other gentleman. Anybody else? [1:39:25, 1:39:38]: Anybody else? This is disapproval or comments that you have that may not be flattering, I guess, in this aspect. So let's just go for um Miss Holbace, we start the clock with as soon as this gentleman talks. Come on up to the mic, sir, give you name and address, please. [1:39:41, 1:39:56]: Good evening, Mayor. Council. Mayor Ford. Those who were in support of this development, I don't know if you asked for the clock. I'm sorry? Did you ask for the clock to start? Yes, I did ask for the clock to start. [1:39:57, 1:40:01]: For those who are in support of this development. [1:40:01, 1:40:04]: I asked the clerk to start. Thank you, sir. Thank you. [1:40:04, 1:40:06]: Okay, so name and address please. [1:40:06, 1:40:26]: Uh good evening. My name is uh Mr. Gibson. Uh my address is 137 East Atlanta Road, which is right next door to the proposed property. Okay. Um I'm here, you know, we're not against any growth in uh in this area town. Uh we think is needed, but we just don't feel like it's the right location for where it is. [1:40:26, 1:40:46]: Is directly located to next door to our property. It was just uh against the approval of it. And uh we're concerned about the additional traffic it's gonna bring, uh, the look that it's gonna bring, uh, especially with the current residence that's right next to it. And uh we feel like uh it's gonna [1:40:47, 1:41:07]: Give some issues with the setbacks. We have issues with the setback being so close to our current property. You know, and then he talked about putting up a fence. I mean, how's that gonna look with this fence right along the side of my property? So I'm concerned about that. And uh, you know, me here, just hope that you would take that in consideration and uh [1:41:07, 1:41:16]: And um we're totally against it. Okay, thank you. Not against growth, but I'm against this project and the location that it's in. All right, thank you. Appreciate it. All right. Next element, sir, name and address, please. [1:41:23, 1:41:42]: Good evening. Thank you, uh Mayor and Council for having us. My name is Phil Crosby. I um I'm a former Henry County Commissioner, so I've been in your seat. I've been uh over here. Um Your address please, sir. Uh excuse me, uh 118 Duval Drive. [1:41:44, 1:42:04]: Uh this project is bordered by Bryant Street and Duval Drive. And if you go and ride down those streets, you'll find that the acreage per unit averages close to three quarters of an acre. I myself, uh my lot's an acre and a half. [1:42:05, 1:42:08]: And now we're going to drop a high density. [1:42:10, 1:42:15]: For lack of a better word, apartment looking complex and call'em town homes. [1:42:17, 1:42:37]: In the middle of that, uh, my first question would be value. What are you doing to the value of my home? We've been there thirty-seven years. And to Mr. Alexander's point, yes, my house was built in 1968, but I spent many thousands of dollars this past year doing. [1:42:37, 1:42:57]: upkeep, paint, new furnace, new water heater. You know, and the list goes on and on. And it's what everybody has to do. But you know, w we we've uh pride ourselves, I feel like, on Duvall Drive to try to maintain good homes and good looking homes. And yet [1:42:57, 1:42:57]: Mm. [1:42:58, 1:43:02]: We're g we're gonna end up with uh an apartment looking uh [1:43:03, 1:43:23]: Development and uh I need to back up a moment. I've spent 50 years in the construction industry, so yes, I'm not against development or redevelopment, as the prior uh young man said, but I'm not for uh things that are gonna completely change. [1:43:23, 1:43:38]: change the neighborhood where I've lived for thirty seven years. And there again that goes back to to uh what will it do to to my value, to my neighbor's value. [1:43:40, 1:43:41]: Uh [1:43:43, 1:43:50]: Second uh thing that I'd like to bring up is we have a uh storm drain problem on Duval Drive now. [1:43:51, 1:43:52]: A bad one. [1:43:53, 1:44:03]: Uh water still running very heavily through my neighbor across the street's yard, comes to a catch basin, under the street, and through my land. [1:44:05, 1:44:11]: We have Lake Duval in the entrance. If you turn off East Atlanta on to Duval Drive. [1:44:12, 1:44:14]: We could stock it with bass this afternoon. [1:44:16, 1:44:35]: Um part of that was due to Clayton County's uh water main that comes down through there a few years ago and the way it got paved and now it's been repaved and it's made it even worse. But the uh also part of it where they're wanting to put the project is at the crest of the hill. [1:44:35, 1:44:39]: So all their water is either got to go on. [1:44:39, 1:44:44]: East It uh Atlanta Road or down through us. [1:44:45, 1:44:48]: And that's something that needs to be looked at real hard. [1:44:48, 1:44:52]: If it goes down East Atlanta Road, we don't have the capacity down through there. [1:44:53, 1:45:00]: I remember when the sidewalks were put in and the storm drain and the catch basins were put in there. Uh capacity's not there. [1:45:01, 1:45:06]: And here we are wanting to pave all of that acre and two thirds. [1:45:06, 1:45:08]: And put rooftops on it. [1:45:09, 1:45:21]: ten foot sidewalks and only ten foot of grass to absorb it all, or fifteen, whatever. Um uh th there are a lot of challenges there. [1:45:22, 1:45:27]: What about ingress and egress? If they y get their variances they've asked for [1:45:27, 1:45:33]: You won't have room to go to East Atlanta Road and say we've got to have a D cell lane. [1:45:34, 1:45:39]: Twenty seven units times two cars is fifty four cars to get in and out of there. [1:45:39, 1:45:41]: Twenty four hours a day. [1:45:43, 1:45:45]: Then they brought up the garbage trucks. [1:45:45, 1:45:47]: Can they get in and out of there? [1:45:49, 1:45:49]: Um [1:45:50, 1:45:52]: And then my real concern. [1:45:52, 1:45:55]: is uh public safety and fire department. [1:45:56, 1:46:01]: We start talking about three foot uh side setbacks. [1:46:02, 1:46:13]: and ten foot. Ten and ten makes twenty. You won't get a fire truck there. If you have a fence right up against your neighbor's house next door, how does the fire department get to the back side of that unit? [1:46:14, 1:46:15]: should they need to. [1:46:17, 1:46:26]: Now Lord uh God help us. We don't want to fire. I'm not at saying that. I'm saying that problems come about. [1:46:26, 1:46:36]: and to get that firetruck in there and if they need to get to the back of that building, what are you gonna do? You just got to stand there and watch it burn. [1:46:37, 1:46:47]: So those are a few of the things. Uh we've talked to a lot of the neighbors. We didn't know about this till last night. We got a phone call. Uh didn't realize it. [1:46:49, 1:47:03]: And so I'm just bringing up some concerns. I'm not like I say we're not against development or redevelopment, but this is an improper use and it's a misuse of the uh land use plan that we paid for. [1:47:05, 1:47:08]: as uh citizens uh of the city. [1:47:08, 1:47:09]: And as counsel [1:47:10, 1:47:25]: When and the mayor we we used our money and paid for that thing, and now we're not really following it, we're deviating from it. So we have great concerns along that line. Thank you. Thank you, sir. Next gentleman, please name and address. [1:47:28, 1:47:40]: My name is Rusty Dobbs. I live at 119 Duval Drive. Uh good to see you again, Mr. Mayor. Um echoing uh what Commissioner Crosby said, uh we're already enjoying uh the runoff from the amphitheater. [1:47:40, 1:47:46]: Um there there was m mention made of a fence uh surrounding this product. Um [1:47:46, 1:47:58]: no commitment of offense of any kind, uh only a buffer. Um is this is this I w just would I ask, is this uh complex going to be uh individually owned or is it gonna be owned by one person? [1:47:58, 1:47:59]: Um [1:48:00, 1:48:07]: Uh also the um the traffic uh that that complex that massive complex that they just built down the street beside Rico's [1:48:07, 1:48:12]: is not even occupied yet. So we don't even know what the impact that that's gonna have. [1:48:13, 1:48:31]: uh on East Atlanta Road. I've lived at 119 Duval Drive since I was nine years old. It's almost fifty years. Uh when I was young, I could pull we could pull the top of my road and not even have to look in either direction to pull out on East Atlanta Road. Now it's a parking lot. I would just like for the council um and and and parties involved [1:48:31, 1:48:51]: To at least wait until that until that unit the the the development down beside Rico's is is occupied and see what the what the impact is. There's been talk for 20 years now uh of extending Rock Quarry Road uh down to uh Valley Hill. That would alleviate some of the traffic. We had a traffic problem. I mean, I understand the old town stopridge. [1:48:51, 1:49:03]: I've uh I used to play centipede in the pool hall uh when I walk home from school back in the 70s. So I've lived in Stockbridge a long time. Sto Stockbridge is uh is a little railroad town, it's a charming little railroad town. Um but uh [1:49:03, 1:49:15]: right now, um, East Atlanta Road and what what's gonna happen if East Atlanta Road has to be widened at some point? I mean you're gonna have this you're gonna have this massive complex what, ten feet off the road. There's nowhere to go. [1:49:15, 1:49:16]: Um [1:49:16, 1:49:36]: And I would also kind of wonder what it's gonna be like for these residents uh at about nine o'clock or ten o'clock at night when uh there's a concert going on at the amphitheater. We're we're uh hundreds of yards away. And uh it we could it it rattles our windows now. So I mean I don't personally don't think it'd be a very pleasurable place to live. [1:49:36, 1:49:40]: live based on what they're gonna be experiencing from the amphitheater. Um [1:49:41, 1:50:01]: The the again the the the water runoff um it's just it's it's a very small piece of land. You're talking about putting twenty-seven units on on a little over an acre and a half. My my lot on Duval Drive is right at an acre. And and to and to to envision putting twenty-seven of anything, you can't put [1:50:00, 1:50:04]: three single wire trailers on my property and it'd be a comfortable [1:50:04, 1:50:24]: to be able to move around comfortably. This is like m like Commissioner Frosby said, um, it's gonna be very tight and it's gonna be dangerous. And it's for the people that that buy these or rent these, that that wasn't made clear, uh it's not gonna be a pleasure uh pleasurable experience when uh when the van comes to town. So I I appreciate I appreciate the opportunity to speak. [1:50:24, 1:50:44]: Thank you. What what it amounts to is that counselor you're willing to give them extra time because we have another lady set up here to speak. So okay. So we'll get some extra time. So go ahead and finish your comments and we'll let you know. Oh no, that was really all I had to say. It's just it's just too much and too small a space. And and again, um we live at the bottom of that hill. Okay. And we're already dealing with water now. You look down [1:50:44, 1:50:56]: at Brush Creek right now. It's it it's it's but it's banks. So more water coming down hitting down that hill ain't a good idea. So I mean that's what I'm saying. Okay I appreciate it. Thank you. Appreciate it. Thank you sir. Ma'am come come Depoli and please your name and address [1:50:59, 1:51:05]: My name is Donna Barge and I'm gonna speak loudly to wake people up and to hopefully uh [1:51:05, 1:51:09]: be heard because it's been really hard to hear things tonight. [1:51:09, 1:51:23]: So um I've lived in Stockbridge for about 59 years. I've been a homeowner in uh Stockbridge since 1985. My husband and I make our home on Duval Drive right now. [1:51:24, 1:51:25]: And um [1:51:26, 1:51:30]: How many square feet per unit did you say you were gonna have here? [1:51:30, 1:51:43]: Well I've I forgot to w well I'll get I'm taking notes and we'll get to answer to that. Once you're done with your comments, I'll bring'em back up. We'll we'll we'll Okay, because here's the thing. You're talking about quality of life and how you want your children and grandchildren to grow up here. [1:51:44, 1:51:48]: I don't think you're gonna get what you think you are right there because [1:51:48, 1:51:53]: We have a daughter who rented an apartment down on Twenti One. [1:51:54, 1:51:57]: It was about seven hundred square feet. [1:51:57, 1:51:58]: And [1:51:58, 1:52:03]: They were paying almost as much in rent for that as they are paying in a house note. [1:52:03, 1:52:11]: And some of these older homes that you talk about, which I happen to be a little bit fond of those older homes. I've called it home for a long time. [1:52:12, 1:52:19]: Um n another thing is the traffic, of course, because they were not able to enjoy the quality of their life. [1:52:19, 1:52:28]: down there at twenty eighty one because if you know anything about that inter s that area down there, traffic is absolutely horrible. [1:52:29, 1:52:30]: And you have [1:52:31, 1:52:32]: Two lanes right here. [1:52:32, 1:52:35]: How is that gonna be any better? [1:52:35, 1:52:39]: Емерженці вікл з арека. [1:52:40, 1:52:50]: I mean if if you want to move over, where is there to go? And if you have these small variances that you're talking about, how does that get any better? [1:52:51, 1:53:01]: Plus, like Rusty said, you've got uh these lots that we've got in Stockbridge that are larger lots. I like I think ours is about an acre and a third. [1:53:02, 1:53:07]: Um you can't fit so you've got three talls, so that makes nine [1:53:08, 1:53:12]: Say double wides, some kind of little bitty trailer or something. [1:53:12, 1:53:15]: You've got nine of those to sit on my property. [1:53:15, 1:53:33]: I don't think that's a very accommodating situation. Plus you've got two car garages for everybody. Well, my daughter also had garages underneath her um apartment. Well guess what? You've got carbon monoxide seeping up into their ventilation system from that. [1:53:34, 1:53:39]: And furthermore, a lot of those apartments are not occupied right now. [1:53:39, 1:53:43]: Furthermore, the crime rate is higher in those areas. [1:53:44, 1:53:47]: Um let's say modernize, okay. [1:53:48, 1:53:51]: I'm I'm sure we could stand a little updating here and there. [1:53:51, 1:54:00]: But is modernization the does that trump everything? That doesn't mean better quality of life to me. [1:54:01, 1:54:04]: In fact, that might mean we're backing up. [1:54:05, 1:54:20]: Um erosion, we've already talked about that over and over. We have a floodplain. Well, it's probably not officially a floodplain, but the erosion through our property is horrible on Duval Drive. Two two streets down here. [1:54:21, 1:54:29]: Um let's see, I think I've covered most of it. Um price. What price are you talking about? [1:54:29, 1:54:32]: Can your kids even afford that? [1:54:35, 1:54:40]: Plus you've got the noise from the amphitheater just like Rusty addressed. It's horrible. [1:54:43, 1:54:48]: Ан і да існули гетин верс і та іч концерт геть worse. [1:54:48, 1:54:54]: So there's some major issues that this city needs to address before you do this. [1:54:56, 1:55:10]: And that's what I have to say about it. And I thank you for your time. And I hope you heard what I had to say. And I hope you took it in and you're mulling it over, not just in one ear and out the other, but I truly hope you're listening to me. [1:55:11, 1:55:18]: Thank you, ma'am. Appreciate that. Okay, on that note, the public hearing is closed. We're gonna close the public hearing. Mr. Anderson. [1:55:18, 1:55:19]: Mr. Singer. [1:55:19, 1:55:21]: And Mr McGardner, please come back to the podium. [1:55:29, 1:55:49]: So maybe I might have missed this earlier and if so, shame on me. The actual amount of um the cost factor per se, you're you're talking about uh we talked about uh the the structure, what it looked like. So I'm just kinda wondering and whether or not it's is uh occupied own supposed to be full ownership versus rental, things of this nature. Can you further explain that?'Cause [1:55:49, 1:55:53]: If I missed it, I'm shame on me. Just for clarification for everybody, just to make sure we're tracking right. [1:55:54, 1:55:55]: They're for sale units. Okay. [1:55:56, 1:56:01]: Yeah, I confirm that the intention is fee simple. The the units will be uh [1:56:01, 1:56:16]: for sale at per unit. And someone mentioned that the difference between a single a standalone single family home and a town home. It's just like if you were buy buying a single family home. Um so it'll be sold on the market like that. [1:56:16, 1:56:31]: All right. More to follow in just a bit. Mr. Gardner, what about this Duval Street and this particular flooding per issue or things with the infrastructure there? I mean, what do we know about that? It's something that our public works department needs to handle or or deal with. I I'm not I'm unfamiliar with this. I just wrote that down. It's the first time I'm hearing it. [1:56:32, 1:56:51]: Okay. Uh okay, so obviously so you gotta do obviously do some follow up in in reference to this this issue, what's going on. Supposedly just check it out further. All right. The value of the homes. I've it I've uh once again I might have forgotten, may have slipped my mind. What's what are we talking about? These one of these condos we're going for. [1:56:51, 1:56:57]: It it wasn't mentioned at this hearing, but it was mentioned at the planning hearing right now the the starting price would be three hundred thousand. [1:56:57, 1:57:17]: Three hundred thousand and that's for one, two, three bedrooms or or what's uh they're all three bedroom, two bath. Three all three bedroom, two bath. Well let me ask you this. Could you further explain three bedroom, two baths? What else besides a two car garage underneath anything else that you can mention in reference to those condos, just as a curiosity, what you get for three hundred thousand dollars? Uh well, you know, I I mentioned [1:57:17, 1:57:37]: I showed you some examples of the interior finish where there'd be the court countertop, um high high quality v uh laminate flooring. Um there'll be you know island kitchens with islands, there'll be a sitting area, three bedrooms, I think the elevations have some uh ability to walk outside. [1:57:37, 1:57:57]: Of one of the bedrooms. So those are the kind of high level. Some of these details will are, you know, we're at the beginning stage to get approval to move forward, but that's the concept based on how this development was set up. So it was$300,000, three bedrooms, two baths, you got a garage for two cars. [1:57:57, 1:58:17]: garage on the first floor doesn't make me think that it would me it wouldn't make me think that it disrupt the property values of anybody's homes in around because that is that's pretty expensive is pretty expensive itself in a sense. Yeah I I mean I e exactly and and I would say you know that cuts both ways. Sometimes you hear legacy residents say that new development will increase their [1:58:17, 1:58:28]: property values. So um we we feel very good about the development, we feel good about the prospects of this the city of Starkbridge and that is the starting point. [1:58:29, 1:58:30]: Okay. [1:58:30, 1:58:50]: I'm sorry. So uh in reference to the st the streets, talking about uh you heard probably heard that the streets, uh I imagine the streets are what twenty-seven feet wide per se. I mean talking about ingress, outgress, uh sit public safety. I would think that if you've got the cars that are in the garage, it may and you may have on street parking, even though we probably uh we have [1:58:50, 1:59:07]: have a regulation against that actually. So uh to the point. So I was just kinda wondering about that. Anything you can add to it to Well uh the the it's set up with the two car garages and each unit will have at least some space in front of their garage where if they had guests or whatnot could park. But the you know [1:59:08, 1:59:28]: We would be willing to make that part of the HOA to restrict the residents from parking on the street. The the idea is that even though we are we have a a smaller site, we're asking to increase the density, we don't want to burden the community with tra with, you know, residents or guests in our development. So the plan is that. [1:59:28, 1:59:42]: There won't be any on st on street parking in terms of East Atlanta. Whatever parking will will be for the residents and or their guests will will be on site. In fact, there are a couple uh I think it's like five or six spaces [1:59:42, 2:00:02]: For guest parking as well. Okay, in in the development. Correct. And just a cure. T-SPLOST passed a couple years ago for us. Rock Quarry Road extension is part of that process that we're gonna work it out with the county and get funds for that. And that would take it from uh Rock Quarry would extend actually to uh to Old Conyers and won't connect to uh Valley Hill that I know of this point, it'll connect to O'Connor's. [2:00:02, 2:00:22]: that help with the process of the traffic flow in the area as folks want to travel back and forth uh to connect to to uh uh uh not only hunter brick but actually eagles lane parkway where the hospital is located in this aspect as well um on that okay on that note i'm i i think that's all i have for right don't don't go anywhere sir any counselor any other questions concerns one second sir miss barber [2:00:22, 2:00:23]: Go ahead, please. [2:00:23, 2:00:29]: I have a statement, it's not a question. Okay. So once he's done, then I will I'll speak. [2:00:30, 2:00:31]: Mm. What's your what's the [2:00:33, 2:00:45]: What I have to say is not a question, it's a statement. Okay, go ahead. So once he's finished you're finished with your presentation. Yeah. Well, I was just asking I'm he he may need to stay'cause counsel may have some other questions for him. [2:00:45, 2:00:46]: No. [2:00:46, 2:00:50]: Well there are some questions. Okay, to council what's your statement, ma'am? [2:00:59, 2:01:09]: Therefore one one second, sir. I think she's yielding the statement until I think she's looking for something. Are you ready are you gonna speak now or excuse me? I'm ready. Go ahead, please. Okay. [2:01:10, 2:01:14]: I support our city's efforts to revitalize the downtown area. [2:01:15, 2:01:26]: I have the unique responsibility of representing stakeholders who are farthest east of our city and farthest north and everything in between. [2:01:26, 2:01:29]: including the downtown area. [2:01:30, 2:01:34]: I've spent time speaking with the residents who live nearby. [2:01:34, 2:01:36]: Including homeowners who live [2:01:36, 2:01:39]: right next door to this proposed development. [2:01:40, 2:01:43]: I believe one of them is here today. He's already spoken. [2:01:45, 2:01:47]: I've listened to their concerns. [2:01:48, 2:01:49]: First I wanna say [2:01:49, 2:01:50]: I'm impressed. [2:01:50, 2:01:52]: With the product. [2:01:52, 2:02:00]: I'm impressed with the conceptuals and the renderings of the proposed three story townhomes. I do support redevelopment of our downtown area. [2:02:01, 2:02:03]: But I do have concerns with this proposal. [2:02:04, 2:02:06]: Our city's comprehensive plan [2:02:06, 2:02:11]: is the official development policy and impl implementation guide. [2:02:11, 2:02:25]: Although requests can be made to amend the comp plan, it should not become a routine occurrence. It defeats the purpose of having a policy where there are consistent amend when there are consistent amendments to allow developments. [2:02:26, 2:02:31]: I cannot support the request for variances to make this proposed development fit. [2:02:31, 2:02:32]: At this time. [2:02:32, 2:02:37]: To reduce the front yard setback, to reduce the required side yard setbacks. [2:02:38, 2:02:40]: To increase the allowable lot coverage. [2:02:41, 2:02:43]: I support principles of smart growth. [2:02:44, 2:02:53]: If our city should consider moving forward with widening East Atlanta Road from Love Street, headed east towards Mays Road to four lanes. [2:02:53, 2:02:59]: I'm concerned there would be challenges with acquiring areas for the road widening. [2:03:00, 2:03:03]: in addition to adding ten foot sidewalks. [2:03:04, 2:03:09]: The proposed development doesn't mention ingress or egress. Safety is a concern. [2:03:10, 2:03:15]: How will buses and emergency vehicles access the already compacted area? [2:03:15, 2:03:17]: It has been challenging. [2:03:17, 2:03:18]: With getting the buy in. [2:03:19, 2:03:20]: From the nearby neighbors. [2:03:21, 2:03:22]: As you can see. [2:03:22, 2:03:23]: Many of them are here. [2:03:24, 2:03:25]: Because they're concerned. [2:03:28, 2:03:40]: It's challenging getting the buy-in without a true public benefit of adding twenty seven townhomes on a one point six five acre lot with no commercial component. [2:03:41, 2:03:45]: There are already five townhome developments that have been approved. [2:03:45, 2:03:47]: For City Council District Four. [2:03:47, 2:03:48]: One of which [2:03:49, 2:03:50]: Is almost at completion. [2:03:51, 2:03:54]: Del Monte Town Homes, next to Rico's Mexican restaurant. [2:03:55, 2:04:02]: I expect that the other four townhome developments will begin construction later this year or sometime next year. [2:04:03, 2:04:12]: With considering the public benefit to approving the amendment to the comp plan, approval of the rezoning from suburban residential. [2:04:12, 2:04:15]: To special purpose multifamily. [2:04:15, 2:04:16]: Without a commercial component. [2:04:17, 2:04:18]: And the variance request. [2:04:19, 2:04:22]: I don't believe it would be a good fit at this location if [2:04:22, 2:04:23]: At this time. [2:04:24, 2:04:26]: I cannot support this proposed development. [2:04:26, 2:04:29]: And I like to make a motion when it is appropriate. [2:04:29, 2:04:34]: Well g one second. Uh Mr Thomas, please. I think Mr. Berry will Okay, I'm sorry, Mr. Berry then. [2:04:37, 2:04:48]: I did have questions, uh and I'm and excuse me if I didn't hear it earlier, but what would be the square footage of each unit? I missed the square footage response, and then I have a s a follow up question after that. [2:04:55, 2:04:58]: Council may I speak? I'm Nero Carris, I'm one of the developers. Okay. [2:05:09, 2:05:18]: Good evening. Good evening. My name is Derek Harris. I'm a resident of Fulton County, one ten Shady Brook Lane, Atlanta, Georgia. I'm one of the developers on this project. [2:05:19, 2:05:19]: Um [2:05:20, 2:05:40]: There's a couple things I wanted to make note of and address, answer some of the questions. One of the main things is that this is the preliminary part of the uh process. Um, if we're voted for rezoning uh variances and everything, we still have to go through and set a submit full plan. [2:05:40, 2:06:00]: Which you got, which the staff, all the departments of the uh of the city, public safety, watershed would all have to approve and then would come back before council. So this is just the preliminary part of it. So before we could get you know through this whole thing, we still would have to, you know, get [2:06:00, 2:06:20]: approval from you know through the through the for the project um again um some uh as far as the values go almost in every case density increases value whether you go to any municipality whether it's Atlanta East Point Hapeville as the [2:06:20, 2:06:35]: density comes in, it uh increases the value. So homeowners that are worried about values decreasing, um, it usually goes the opposite. Uh what we try to do is work with you know local [2:06:35, 2:06:48]: agents, um, we study the market and we try to f do a project uh that fits within the community. And so we're in line with other town home projects, the pricing and other uh other town home projects within this community. [2:06:51, 2:06:54]: Oh and the square footage was about two thousand square feet. [2:06:55, 2:06:55]: Two thousand. [2:06:56, 2:07:06]: And my second qu second follow up question is, have you and it may be too preliminary to answer this, but has there been a topographical study of the land as far as how is the uh [2:07:06, 2:07:12]: the slope and what what direction would water run off and does it have any impact on the people of Duval? [2:07:13, 2:07:30]: Yeah, so all of that is uh is part of the process we're we're doing right now. Um when we um submit to the city we'll we follow all the guidelines to make sure water runoff is minimal and fits within guidelines of the uh munici municipality. [2:07:31, 2:07:35]: Good. Mr. Thomas? Yes, thank you, Mayor. Um [2:07:39, 2:07:43]: One of my concerns is [2:07:43, 2:07:44]: About the future. [2:07:45, 2:08:05]: And that was the reason I asked about the setback and the gentleman here that uh live will live next door to the property. So my first question is about a buffer um for the gentleman here with his home. And I don't know, Mr. Rainer, if one of you gentlemen could offer that. [2:08:05, 2:08:25]: That what is the buffer um that somewhat protects uh the present homeowner who indicated that he he will live next door to this project? Well that gentleman's property zone SR, Suburban Residential, and uh they're proposing to go to um to MFR, so there'll be a 25. [2:08:25, 2:08:26]: [7707.4, 7720.3]: Okay. Um the other question, I know some of the homeowners mentioned the water runoff, and I think one council person questioned [2:08:40, 2:08:52]: the future as far as widening Eastern Road. I know we'll put it in the turning lane s and and with the setback, I'm I'm just trying to [2:08:52, 2:08:54]: Vidжуalize [2:08:54, 2:08:58]: the future, how can we how can the city come in? [2:08:59, 2:09:12]: to create um a widening after other developments. You know, we have uh the the the ballpark, we have uh uh other developments coming. So I'm just concerned about [2:09:13, 2:09:28]: this particular project that would alleviate the city from being able to come in uh to widen East Atlanta Road at least to to Valley Hill. So maybe uh Mr. Gardner [2:09:29, 2:09:30]: And I don't [2:09:31, 2:09:42]: Th this is just my concern about the Mr. Garner, could you come I'm sorry, Mr Mr Garter, could you come to the podium please? And and see this is why I I talked about land use, comprehensive plan. [2:09:43, 2:09:45]: It and we have to be able to [2:09:45, 2:09:46]: See the future. [2:09:46, 2:09:50]: and plan for the future as opposed to [2:09:51, 2:10:11]: uh spot developments here and there. And I I just don't know, and we know how devastating water is, because you know I experienced that in my neighborhood, but we're coming with curb and gutters. So and I know I don't think there's been any discussion about the widening of East Atlanta from [2:10:11, 2:10:21]: brother down, curb and gutters and all of that. And I'm I'm not asking you to look into your crystal ball and give us an answer, but but these are sort of my concerns and I don't know [2:10:22, 2:10:31]: how you would choose your words to even speak to that. But I am concerned about the buffer with the gentleman's home here and even the future. [2:10:32, 2:10:34]: And so if we're going to [2:10:35, 2:10:51]: attempt to even look at widening Easter Lana Road simply because of development, how is this going to impact that future as far as trying to widen Easter Lana Road? And especially if this with the setback issue and the unit is [2:10:52, 2:10:54]: Just pretty much on the street. [2:10:55, 2:10:57]: Well, good evening, Mayor, Councilmembers. [2:10:59, 2:11:03]: The last time I asked a question to the county about the widening of um [2:11:04, 2:11:13]: Eastern Road, they said that they had no plans on widening Eastern Lana Road, as far as they were concerned, and that's the area north of the city going towards Fairview. [2:11:14, 2:11:18]: Um I've Oxford again, um, just recently when I heard the comment, so [2:11:18, 2:11:23]: But the last time I spoke to the county manager, I think she said that there were no plans on the books to widen. [2:11:23, 2:11:24]: Eastern Lana Road. [2:11:26, 2:11:28]: There's been other conversation about [2:11:29, 2:11:31]: A path trail. [2:11:31, 2:11:42]: um down East Atlanta Road. So I I just don't know how do you uh fit all of these plans into this [2:11:43, 2:11:47]: And I'm just con concerned that we'll we're not focusing [2:11:48, 2:11:52]: on the future plan in in my mind and all my training is [2:11:53, 2:11:56]: You create a vision, you create a plan. [2:11:56, 2:12:00]: And everything, even future growth, everything sort of [2:12:00, 2:12:02]: fits into that because you have [2:12:03, 2:12:07]: Taking the time to study, to visualize [2:12:07, 2:12:14]: and to set some type of future plan and those are the kind of plans, those are the kind of things that [2:12:14, 2:12:22]: you allow to come in are those kind of thing that you go out and look for to bring in because you already have a plan, you already have a vision set. [2:12:23, 2:12:25]: So I'm just a little concerned, um [2:12:26, 2:12:31]: With the future, I guess, if you will, with East Orana Row. I'm just I'm just a little concerned, but [2:12:32, 2:12:40]: I just want to express that and I know it's not really a whole lot of question, but Mr. Anderson, I I don't know if [2:12:40, 2:12:57]: if that satisfied my concern about this gentleman here and I don't know if that even satisfied him. I do feel his pain anytime you have something like this coming directly next door to you, how do you how do you live with that? But [2:12:58, 2:13:18]: But it I I yeah, Mayor, thank you so much. Thank you. You know the comments on the sum. Mr. Alzheimer's, go ahead, please. Yeah, Ryan and Mr. Gardner don't have a seat yet. Okay. Certainly as we go down through this course of where we're trying to go, uh this particular development, as you said, fits into the special purpose category. [2:13:18, 2:13:38]: That's already in the zoning in the zoning comprehensive plan. Yeah, that's the new our newest designation in our comprehensive plan that was adopted in October of last year. Okay, this council voted on that plan? Yes, sir. This council, what was the vote? Unanimous. So the council unanimously approved? [2:13:38, 2:13:42]: approve this category that staff has made this consideration of. [2:13:43, 2:14:03]: Yes, sir. Okay. And staff has did the analysis that's the the work and everything? Yes, sir. I vetted all the studies that have been endorsed and recommended by the by city council, like the Georgetown plan, the LCI study, the downtown bicycle and pedestrian study. This proposal [2:14:03, 2:14:05]: [8046.2, 8062.0]: Okay. And as we looked at the uh study for Georgia Tech Marketing Study, this is the type dense development that they were referring to in terms of growing the downtown population and updating is one of the varieties that they mentioned. [2:14:22, 2:14:27]: Yes, sir, as well as the L CI study and also the downtown pedestrian bicycle study. [2:14:27, 2:14:35]: Okay, as far as the question that was raised about the ten foot sidewalk, this development actually incorporates a ten foot sidewalk, correct? [2:14:36, 2:14:45]: Yes, sir. So basically what would happen is the past sidewalk would actually connect to this if we decided to go at the street side, correct? [2:14:45, 2:14:56]: Yes, that's the goal. As a matter of fact, we already have a ten foot path right outside of City Hall that runs from here on North Henry Boulevard all the way down to Bryant Street currently. [2:14:57, 2:14:58]: Yes, sir. [2:14:58, 2:15:13]: So in essence what would happen is that same sidewall would continue on until uh as the plan is and we talk with Path Foundation to try to connect to Panola one day or four whether that be through the forestry or whether that be down east Atlanta. [2:15:14, 2:15:34]: So certainly that's some of the things that uh we wanna consider. And honestly, I I in an all due fact, I think you guys are being very modest about the price point. A two thousand square foot townhome with this trim level, it's gonna be more than three hundred thousand. We know that. It's probably gonna be three hundred and fifty to four hundred. [2:15:34, 2:15:54]: So in essence, what would truly happen is this development will probably increase the price of the value, of the values of the surrounding properties, not actually detract from them. Is that your what your estimation is in terms of in terms of the properties that are around surrounding based on the study? This would be [2:15:54, 2:15:57]: In excess of what those properties are valued at. [2:15:57, 2:16:08]: Yes, sir. It will and uh I think based on my personal experience and work history, uh projects like this usually result in an increase in the surrounding properties property value. [2:16:08, 2:16:10]: So in essence [2:16:10, 2:16:14]: Uh as was stated before, this is the final approval, correct? [2:16:15, 2:16:17]: But but it's like terms of the council. [2:16:17, 2:16:22]: Yes, this is a pro final approval as far as council concerned, but they still have a long way to go. [2:16:22, 2:16:41]: Right. So what generally happens is in Stockbridge, once the council does the approval, the all of the assessment will be done in accordance with what the law is and you will review the public safety plan, you will review the topo topography, all of that in in regards to this particular plan. Yes, that's that's true and it's kinda um [2:16:42, 2:16:51]: You really can't make um assumptions about the runoff and all that stuff without seeing the topos and the silver plans. Mhm. So to talk about that, uh now is kinda um [2:16:52, 2:16:58]: It's almost like a it's hypothetical. Mm-hmm. Because we don't have enough information to make those assumptions. [2:16:58, 2:17:18]: Mr. Gardner, come to you as well, and uh maybe uh staff. We actually have investing about three million dollars in improving East Atlanta Road uh and lease rate in this general area outside the amphitheater. Uh talk about the project that's going on outside. [2:17:18, 2:17:21]: outside of City Hall now that took an extended amount of time. [2:17:22, 2:17:26]: Uh yeah, sure. So presently we have the widening of East Orland Road. [2:17:27, 2:17:47]: to provide a right hand turn motion that takes you over the North Henry Bridge, um headed towards Walmart. Um that'll be uh a dedicated lane. Right now we don't have that, so that's why some of the traffic congests back beyond City Hall. So there's gonna be a turn lane that starts um [2:17:47, 2:17:52]: I gotta get my bearings. Uh about [2:17:55, 2:18:15]: I would say should be able to stock about twelve or thirteen cars um for dedicated left turning. Uh and so that's being completed now, we should have that done in by the end of uh mid April or end of April. So instead of all of these cars lining up in a single line, as many [2:18:15, 2:18:35]: Many of these residents have been frustrated in the past with just this single lane here. Instead of waiting, they will be able to take the right turn lane and make that turn. That is true. And they will there will be I'm sure I'm sure there will be a signal there uh as well. Y'all see the black mass post arms signals. [2:18:35, 2:18:41]: Dedicated l right hand turn lane that allow for you to at least turn on red if there's no traffic coming. [2:18:41, 2:18:58]: Right. So all of that investment is a is a part of what we've been doing here as part of the L CI plan as a part of the comprehensive plan. In your estimation, you support the staff's recommendation and then this being in keeping with the actual plan for downtown. [2:19:00, 2:19:01]: Uh yes sir, I think this um [2:19:01, 2:19:04]: Community development director spoke um [2:19:04, 2:19:06]: directly to that as it relates to all of our [2:19:06, 2:19:11]: plans that we have adopted and um executed over the last few years. [2:19:12, 2:19:18]: Absolutely. Would it be appropriate for me to call the business owner to the podium? [2:19:18, 2:19:22]: Um if uh if he wants to come to polling that'd be fine. [2:19:29, 2:19:49]: Great new one. Yes, sir. Mr. Sylvan, you you have made some extensive investments in downtown Stockbridge. You've acquired a number of properties. Uh you've seen the the Renaissance strategic vision plan. [2:19:49, 2:20:05]: For the city. So you've seen the plan, right? I have. You're aware of the plan. I'm aware of the plan. Okay. And uh with your investments, you understand that your investment will have to comply with the plans of the city and you support those plans of the city. Absolutely, one hundred percent. [2:20:05, 2:20:25]: Okay, the the Renaissance strategic vision plan calls for this type of um density in downtown, not just on this side of the bridge, but on the other side of the bridge where we would have uh retail on the bottom and we would have residential on top uh of those particular units on the other side of the bridge. Are you aware of that? I am. Okay. [2:20:25, 2:20:30]: And are you supportive of making that happen in the businesses that you have invested in? [2:20:31, 2:20:34]: I am one hundred percent supportive of doing that. [2:20:35, 2:20:55]: You so what I I just want to know a little bit. You've made these investments in downtown as a business owner. Everybody's here to make money. Obviously you're here to do that. Tell us why you the these um the the these fit into where you were trying to go and [2:20:54, 2:21:00]: where the city is trying to go and what you wanted to see uh in your in in this community. [2:21:01, 2:21:21]: Well, uh first of all, I've been in this community for about 30 years now. And I've been investing in this community since nineteen ninety-eight. Most of my commercial properties are in Stockbridge. I own roughly, I think, ten commercial properties in the city of Stockbridge, happens to be in District 4. [2:21:21, 2:21:24]: four and at least seven of those properties in the downtown area. [2:21:25, 2:21:29]: continuing to invest. Uh this is actually something that um [2:21:30, 2:21:38]: I I mean I really appreciate the efforts that you guys are putting in to try and grow the downtown. You say you want a functioning downtown area. [2:21:39, 2:21:50]: Uh we must have density in order to do that. So this is why I've been purchasing properties. Again, I teamed up with the young men out of Atlanta. We have some properties that we've invested and developed in the Atlanta area. [2:21:50, 2:22:01]: They saw the vision here. So we're continuing to invest in the city of Stockbridge. The properties that's along um East Atlanta Road, yes, I know it's already zoned to be able to go up. [2:22:02, 2:22:05]: The plans are to eventually go up on those as well. [2:22:05, 2:22:12]: And hopefully you guys will support what we're trying to do on East Atlanta Road. And once we get that passed, there's more to come. [2:22:12, 2:22:16]: As you said, Councilman Alexander, I've been investing in this city for quite a while. [2:22:17, 2:22:29]: Uh and sometimes I wake up and I ask myself, is this what I want to continue doing? And most in most cases I say yes, I want to continue doing it. Vinon Raj, whenever an opportunity comes, becomes available. [2:22:30, 2:22:32]: They contact me, let me know of a property. [2:22:32, 2:22:38]: I jump right on it and as you guys have heard me say in the past, I'm going to continue it continue investing. [2:22:38, 2:22:43]: You guys are the policy makers for the city. I have to abide by. [2:22:43, 2:22:45]: The policies that you guys put forward. [2:22:45, 2:22:54]: So the question becomes, do you want a thriving downtown or you want downtown to look the way it's looking now, the same way it's looked 20 years? [2:22:55, 2:22:56]: And either way [2:22:56, 2:23:08]: If you say yes, this is what you want, I understand. If you say no, this is not what I want, I understand. So you guys are the policymakers. Hopefully you guys will support the project that we're trying to do on East Atlanta Road. [2:23:08, 2:23:28]: Talk about your development experience. I understand you do have some properties that uh have been developed ins inside the country club and actually expanded the country club. Those are very high dollar investments or homes. Yes. Talk about that development and the quality of [2:23:28, 2:23:32]: of that so we can understand what you've done in the past. [2:23:33, 2:23:53]: Okay, well um I guess uh in two thousand eighteen I purchased uh fifty acres that butts up against the country club on Peach Drive, if you guys are familiar with it. Uh we took those eighteen, I'm sorry, those um fifty acres and we developed forty-three lots, uh going anywhere from one hundred twenty-five thousand to two hundred and fifty thousand dollars. [2:23:53, 2:23:56]: As of today, we have two lots that's available. [2:23:56, 2:23:59]: And only uh one is actu actually under contract. [2:24:00, 2:24:09]: So again, like I say, we've been investing in this community for quite a while. And I'm going to be honest with you, it's risky what we're doing. [2:24:09, 2:24:18]: It's risky what I'm doing downtown. Uh if I cannot get the support of the mayor and council, then what's what's the point of continuing to move forward? [2:24:19, 2:24:39]: So it well so everybody is real real clear. That's the value of the land that you're talking about. Yes, that's for the land. The homes are going to go anywhere from eight hundred to a couple million dollars. So um yeah, and as you say, we're actually we're being conservative on [2:24:38, 2:24:48]: the ones uh that we're looking to develop and they're not apartments. I think it's going to take the value of everything around it up. It's not going to cause any decreases in value. [2:24:49, 2:24:57]: So in the last question that I have, as the business owner of the business, you actually are the the property owner of Frozen Smoke, correct? [2:24:57, 2:25:11]: I yes, I am the property owner of the process. Okay, you're the property owner of a couple of different properties. So one sixteen as well. Right. So for that business to be successful, uh, as we are here, you need the business owner, Mr. uh Washington as well, need [2:25:12, 2:25:15]: clientele that can actually be on there. I think [2:25:15, 2:25:32]: kind of similar to what we did at Johtoco, these new businesses that we're trying to track, they want to have clients within walking distance. And that's something is that something that is of interest to you all? It's yes, it's it's necessary. If we cannot get the density, the businesses will suffer. [2:25:33, 2:25:37]: We got to have density in the downtown area. Otherwise it's self-defeating. [2:25:38, 2:25:50]: And hopefully eventually the three acres that sets across from City Hall, hopefully that will be developed at some point. We're also looking at another piece of property in the area that we uh we would be looking to do some mixed use there as well. [2:25:51, 2:25:55]: Absolutely. I appreciate it. Thank you. Okay, no problem. Any other questions for the council? Anyone else? [2:25:56, 2:26:01]: All right. Thank you, sir. Appreciate your time. Thank you. All right. All right, Council, this is what we're gonna do. Let's go go back through this. [2:26:02, 2:26:22]: Once again, it's a public hearing. So comprehensive plan amendment KCP 2023-08. Once again located in Council District 4. Consideration of a request for a comprehensive plan amendment to change the future land use designation of certain property 135 to 305 East Atlanta Road from low density. [2:26:22, 2:26:42]: Mixed use to special purpose to allow for construction of town home development. The applicant once again is Harold R. Singer, Jerry Jr., a Gibbon Consulting Group that property contains two parcels of land lot 68 of District 12 and listed for 1.65 acres within Starbucks City Limits, and of course the planning committee. [2:26:42, 2:27:02]: Commission once again recommendation was approval. Staff recommendation was approval. 135 East Atlanta Road parcels S25-01022000 contains 1.208 acres and 305 East Atlanta Road parcel S25-01022005. [2:27:02, 2:27:11]: contains.37 acres, and so I need a motion to uh accept uh this proposal, this recommended change. Yes, ma'am. [2:27:11, 2:27:18]: This is a proposed development in my district. Yes. Well go ahead. I'd like to make a motion. Um [2:27:21, 2:27:23]: I have to consider the [2:27:23, 2:27:27]: concerns and quality of life of the residents. [2:27:28, 2:27:30]: Who live nearby? [2:27:30, 2:27:35]: I support redevelopment of our downtown. I want to be real clear about that. [2:27:36, 2:27:40]: However, I don't believe this particular development is a good fit. [2:27:41, 2:27:42]: For this location. [2:27:42, 2:27:43]: At this time. [2:27:44, 2:27:45]: There are two homes. [2:27:46, 2:27:47]: Right next door to it. [2:27:48, 2:27:50]: I am concerned about those homeowners. [2:27:50, 2:27:52]: I'm concerned about the other homeowners. [2:27:53, 2:27:56]: who live nearby as well. Okay. [2:27:56, 2:27:59]: East Atlanta Road is already [2:27:59, 2:28:02]: Um congested. Okay. Most times. Which a mo especially [2:28:03, 2:28:04]: During [2:28:04, 2:28:06]: Concert season. Okay. What's your motion? [2:28:07, 2:28:14]: I will make a motion to deny this proposed development to amend the comprehensive plan. [2:28:15, 2:28:16]: All right, sir, a second to that motion. [2:28:18, 2:28:32]: Is there a second to that motion? There is no second. I need a motion uh to approve this particular proposal, please. So moved. Is there ms for Mr. Uh Alexander? Second? I second. Ms. Cant, second. All favor, please indicate. [2:28:34, 2:28:35]: Okay, all polls? [2:28:36, 2:28:37]: You'll stay in. [2:28:37, 2:28:42]: What you you oppose or sustain? I oppose. [2:42:08, 2:42:08]: [9729.7, 9742.6]: Forty nine hundred North Henry Boulevard second track, but a different parcel ID numbers contains two point two one acres. And the parcel on C Center Street, which is which which doesn't have an address, contains point five six of an acre. [2:42:25, 2:42:36]: Currently, the property is occupied by a funeral home and a garage apartment at forty-eight forty four and forty-eight eighty-two North Harry Boulevard, plus vacant land on the other three parcels. [2:42:40, 2:42:42]: existing zoning um [2:42:44, 2:43:04]: Let me back up. Um to the north of the pro to the north, let me get the surrounding um land uses and zoning. To the north of the properties, you have vacant land. To the west, you got Stockbridge, Taekwondo Academy, and the Club Drive Subdivision. To the east of the property, you have Holly Salon and Emeris Bank. South of the property, you have North Henry. [2:43:04, 2:43:09]: Boulevard and northeast of the property you got Oakill Manor and turning point subdivisions. [2:43:12, 2:43:24]: The surrounding zoning, you have OI to the west, SR to the north, MFR to the east, and northeast. And the surrounding land use densities, you got low density mixed use and and uh medium density residential. [2:43:28, 2:43:44]: Most of the site is wooded except for the um the funeral homes in the and the garage apartments that are located on North Henry Boulevard. Here's the vicinity map right here. Here's highlighted in red is the property and the other properties are drawn below that are highlighted. [2:43:44, 2:43:48]: C one second. Um What's what's the [2:43:49, 2:43:57]: Where where is this in relation to uh the proposed culture artisan? [2:43:58, 2:43:59]: Uh [2:44:00, 2:44:01]: Let me see if I can get a better review. [2:44:06, 2:44:15]: Uh my my understanding is I know you're gonna answer the question, my understanding the pr as you look at it, the proposed cultural art center is to your right, which it'd be m actually to the east of this. [2:44:15, 2:44:16]: Is it on the map? [2:44:17, 2:44:18]: Yeah. [2:44:18, 2:44:19]: Okay. [2:44:21, 2:44:30]: See how Yeah he has the pr m Mr. Garden has the prompt on the location for the proposed cultural options. Can you scan over a little bit more? That's the end of the page. [2:44:30, 2:44:39]: That's the end of the map. You can but so in other words, this property does not um border the proposed cultural arts center in any way. [2:44:39, 2:44:53]: No sir, it doesn't. Okay, so this property actually backs up to uh West Burke Street and then that existing that existing neighborhood and and the bank. It's parking lot back there. [2:44:54, 2:45:05]: Oh sorry, sorry, the West, the right there, okay, I'm sorry. It's it backs up to what are those two structures behind it? What where? That's that's it right there, right. Okay. [2:45:06, 2:45:11]: What struck was struggles? The two properties behind it. Let me see, can I f uh blow it up? [2:45:28, 2:45:40]: Okay, I uh you're probably not gonna be able to zoom any more than that, but this parcel is nowhere near the proposed cultural arts center in terms of uh bordering it in any way. [2:45:41, 2:45:42]: It's down the street. [2:45:42, 2:45:44]: Right. Okay. Right. Thank you. [2:45:46, 2:45:58]: Mayor? Yes, sir. I'm sorry. I know he sort of spoke out of turn before Mr. Anderson finished. Um, but when Mr. Anderson finished I I will let you say. Thank you. Go ahead, Mr. Anderson. Okay. [2:46:02, 2:46:10]: Here's the aerial photo of all the five properties involved in the rezoning and all the zoning other zoning application. I'm sorry. [2:46:15, 2:46:17]: Here's the zoning and overlay district map. [2:46:24, 2:46:26]: This is the future land use map of the properties. [2:46:29, 2:46:32]: This is a boundary boundary survey of the properties. [2:46:38, 2:46:54]: Uh the applicant is proposing 90 townhomes at a density of 5.76 units per acre. All units will have three bedrooms. The minutes would include a pool, cabana, dog park, and open spaces. Uh site access, you have the main entrance off North Henry Boulevard. [2:46:55, 2:47:15]: However, it needs a G Dot uh right-of-way permit. Emergency access off club pace at the rear of the site. Uh the traffic impacts about 40 trips in the morning and about 47 trips in the afternoon peak hours. According to the traffic study, there will be minimum adverse impacts, uh, especially since North Harry Bull. [2:47:15, 2:47:17]: is a principal arterial. [2:47:23, 2:47:25]: Thirty percent of the site will be open space. [2:47:31, 2:47:36]: thirty percent of the site will be open space, exceeding the required minimum fifteen percent. [2:47:38, 2:47:54]: Thirteen townhome buildings, space that twenty feet apart, a variance to reduce the front yard setback of the lot of the lots from 50 feet to 30 feet. Lots would be twenty-four feet wide for two car garages and twenty feet wide for the proposed one car garages. [2:47:56, 2:47:57]: Here's the conceptual site plan. [2:48:06, 2:48:07]: Here's another [2:48:08, 2:48:10]: version of the conceptual site plan. [2:48:21, 2:48:24]: This is the diagram of the proposed townhome lots. [2:48:28, 2:48:28]: [10109.0, 10115.8]: Here is a rendering of the proposed two car I mean of the one car garage units that they are proposing. [2:48:37, 2:48:39]: Here's a rendering of the two car garages. [2:48:47, 2:49:07]: Uh four of the parcels are designated four of the parcels are designated as low density mixed use, which allows low intensity mixed uses to serve the surrounding neighborhood. The real parcel of 4,900 North Henry Boulevard is designated as medium density residential, which allows single family detached homes and single family attachment. [2:49:07, 2:49:19]: attached townhomes at a density of four point four to seven point nine nine units per acre. The applicant wishes to change all that to the same land use designation of medium density residential. [2:49:22, 2:49:37]: Staff recommends approval of the of the comp plan. Uh before I go into the um rezoning with you, you have some questions. Yeah, if yeah, if there are any specific questions on the comp plan before you move on. Council, any specific questions, comp plan? If he wants to ask a question on that. [2:49:38, 2:49:42]: Well on on the comp plan now. Let's deal with the comp plan. We're gonna get to your rezoning variations in a little bit. [2:49:43, 2:49:48]: You c you got a question, sir? Yeah, the the density level, go go back to that frame. [2:49:52, 2:49:57]: Density is re is the density is relatively low. It's five point seven units per acre. [2:49:58, 2:50:18]: So this is actually uh not in the high density category. No, sir. This is actually on the low end of medium density. On the low end of medium density uh versus what we've been seeing come to us, right? Yes, sir. So in essence if they had went for the higher density, they could have many more units, correct? Yes, they could have applied for many more units. [2:50:18, 2:50:19]: Thank you. [2:50:20, 2:50:20]: Yeah. [2:50:20, 2:50:21]: Yes, go ahead, please. [2:50:22, 2:50:25]: Um so in regards to the [2:50:26, 2:50:30]: Land use designation. I know the [2:50:30, 2:50:33]: Parcel that is forward facing North Henry. [2:50:34, 2:50:37]: Is designated as commercial, correct? [2:50:38, 2:50:51]: Yeah, that's with the more shit. It's OI the zoning. Thank you. Okay, but the land use is something else. Okay. No more uncomprehensive we'll go to the uh zoning right now, sir, please. Okay. [2:50:53, 2:51:13]: Instead of showing all those slides, I'm just gonna get to the um the analysis. Is the uh the rezoning proposal consistent with the comprehensive plan? Yes. It's located on a road having a classification of collector or hire, which is required for the ML MFR district. Yes, the pr the property is located on a principal [2:51:13, 2:51:33]: Arterial, which is North Henry Boulevard. North Henry Boulevard is a principal arterial. Compatible with the adjacent MFR zoning district? Yes, it would be compatible with the with the MFR zoning of the Oakia Manor and turning point subdivisions to the east and northwest. It would also be an acceptable transition between the C1 and C2 districts to the west and either. [2:51:32, 2:51:52]: East along North Henry Boulevard in the large SR district to the northwest. Physical suitability of the property. Although the property has an irregular shape and it is bordered by Brush Creek and its floodplain areas to the north, the site plan shows that an acceptable design would be used and the sensitive property of the area would be voided. [2:51:52, 2:51:56]: Five. [2:51:58, 2:52:18]: Well, impacts on adjacent property owner. There will be minimal these will be minimal since no access would be provided on to the adjacent subdivision street except for emergency access. Also a twenty five foot zoning buffer would surround the site and a significant open space will be provided along the western side of the property, adjacent to the Club Drive subdivision. [2:52:18, 2:52:19]: Mm-hmm. [2:52:22, 2:52:42]: Utilities Impact. A letter from the Public Works Department dated November twenty second, twenty twenty three, stated that the ward and sewer capacity were currently available to serve the proposed townhomes. Traffic impacts. Number seven, propo projected traffic volumes are anticipated to have a minimal impact on North Henry Boulevard. [2:52:42, 2:52:52]: and the lack of another access onto surrounding subdivision streets will prevent any adverse traffic impacts on adjacent streets. [2:52:52, 2:53:12]: Well uh sorry about that. Uh relations to any other city pro policies, none were identified. Ability of the property to be developed on the current zoning is possible, but it will result in a piecemeal development where the rezoning will would allow for you would not allow for a unified plan. As as a result, staff recommends approval [2:53:12, 2:53:15]: Uh the first condition um [2:53:17, 2:53:37]: Uh we really can't state that now because we don't know what the final um site plan would be, but anyway, this um the proposed townhome development shall be constructed according to a design which is similar to the one that is shown on the applicant's submitted site plan entitled North Henry Town Homes. Uh Access and Streets. The developer shall comply with the requirement. [2:53:37, 2:53:55]: Of the city's fire marshal regarding the location, dimensions, and materials for all site access and internal streets. The developers shall comply with the requirements of the city's public work department in a timely manner for the provision of water and sewer facilities to the development site. [2:53:57, 2:54:17]: Architectural design. All townhome units shall have brick on at least three sides. At least 80% of the townhomes shall have two-car garages. This shall also be a gated community. No more than 10% of the townhome units may be rented at any one time. The number seven, property maintenance. The developer shall create and maintain and town. [2:54:17, 2:54:37]: Town Home Association or Secure Property Management Company all who shall maintain all common areas of the property. And lastly, the developer shall take appropriate steps to preserve Brush Creek and adjacent floodplains, including wildlife protection measures. So we recommend approval with those eight conditions. [2:54:36, 2:54:37]: [10478.4, 10482.7]: Okay. Rezoning. Ms. Barber, I guess you had a rezoning question. [2:54:45, 2:54:55]: So that was the rezoning. I'll wait until we get to that item. Okay, so anybody else gonna be rezoning? Uh m go away, Mr. Thomas. Well Ma Mayor Ford, I I I have um [2:54:56, 2:55:06]: comments about the project itself, it may or may not be a pro because I'm going to recommend we defer and and I wanted to get into why. [2:55:06, 2:55:26]: Oh okay. So let me know when that's approved. Okay, well why don't we uh if there are no questions about rezoning right now, then we'll move on to uh what was the next one? Variance. Variance, yes sir. Yeah, go over to variance, please, sir. Uh the v the the applicant is requesting a variance from fifty feet to thirty feet and it's in line with city council have has have been approving in the past. Uh we've had several uh [2:55:26, 2:55:46]: Um approved zoning where the applicant requested a setback from 50 feet to 30, and city council approved it. But the applicant's proposal do meet the criteria for variance. Criteria number one: whether the property has extraordinary or exceptional circumstances pertaining to its size, shape, or token. [2:55:46, 2:56:06]: Yes, the property has an irregular shape and a floodplain area at the rear along Brush Creek, which limits the amount of buildable land. Well, uh, criteria number B: whether a literal interpretation of the regulations would deprive the applicant of rights which other MFR property owners enjoy. Yes, it would. [2:56:06, 2:56:26]: Applicant may be deprived of the ability to develop a townhome community with lots that are of similar size to those which are found in other MFR districts. Criteria C, whether the granting of the variance will confer any special privileges upon the property owner. No. This type of variance request has been recently approved by city council for several other townhome developments. [2:56:26, 2:56:42]: in the city. Further, the denial of the applicant's request invariants will force the developer to unfairly comply with the required standards in developing the site, even though the fil physical characteristics of the property will make it very difficult to do so, thus creating an unnecessary hardship for the developer. [2:56:46, 2:56:53]: So based on that and the criteria, staff recommend approval of the variants to reduce the front yard set back from fifty feet to thirty feet. [2:56:54, 2:57:14]: All right, Mr. Thomas, you have a question question now? Um, Mr. Anderson, first let me just ask you, did you mention that the site plan was not completed? I mean, there might I mean it's completed, but as far as they're concerned, but if city council approved it based on staff's recommendations, they will have to go back to the drawing board. [2:57:14, 2:57:34]: to eliminate some uh one-car garages. Is that the only is that the only when you say the site plan is not complete, is that the only concern? That's the only concern concern that yes, the only concern. Okay. Yeah. Um I I I want to recommend, I'm not making a motion at this point, but I'm recommending deferral and I'm gonna tell you why. [2:57:34, 2:57:40]: And this council knows this and some of us can't can't get out of the way of um [2:57:40, 2:57:42]: You know, just doing things the right way. [2:57:43, 2:57:46]: Um just recently капа дайз аго. [2:57:47, 2:57:49]: We talked about creating [2:57:51, 2:57:52]: A plan [2:57:53, 2:57:54]: To create [2:57:55, 2:57:56]: А кампус [2:57:57, 2:58:07]: in that area behind the bank, the land that we already own for the cultural arts. We talked about that. Thus far it's just talk, we came up with a name. [2:58:09, 2:58:29]: Mayor Ford. Go ahead, please, sir. But Mayor Ford. Yes, sir. Can you instruct counsel not to mumble and grumble when someone is talking? Be respectful of people that are talking, that you recognize to speak. Right, right. Can can you can you just say that? Mr. Thomas has the floor for folks. Listen to Mr. Thomas. Let him let him speak, let him continue on with his comments, just like anybody else. If you have floor. [2:58:29, 2:58:34]: you continue to speak and everybody else be quiet so we can hear what they're talking about. Go ahead please, Mr. Thomas. [2:58:34, 2:58:38]: Thank you, sir. You're welcome. For for requiring respect as people are speaking. [2:58:40, 2:58:44]: A few days ago we talked about creating [2:58:44, 2:58:45]: А план [2:58:46, 2:58:50]: Ту крети а кампус, а девелмент, а сити план. [2:58:51, 2:58:58]: To create a development. I don't have a problem with that. What I have a problem with is with the process. [2:58:58, 2:59:00]: And how do we do that? [2:59:00, 2:59:03]: It was a great conversation that we had. [2:59:03, 2:59:08]: But what is lacking is we have not taken the time [2:59:09, 2:59:10]: To identify [2:59:12, 2:59:26]: What the plan is, how much land usage do we need to create the vision that we talked? We hadn't even created the vision. We just talked and we put a name out there of a of a campus. [2:59:27, 2:59:28]: No work. [2:59:29, 2:59:30]: Let me s let me say that again. [2:59:31, 2:59:51]: No work has gone into crystallizing this vision. Point of order. What we're talking about a privately owned piece of property to the west of this development. What in particular does this [2:59:51, 3:00:11]: effect does this argument have on that property. Because we cannot dictate what a private owner does with their individual. Let me finish for it. Finish your comment, please. No we cannot dictate what a private entities in the area do with their property. So [3:00:11, 3:00:31]: So I'm trying to understand what this argument about the city property or the uh discussion we have has to do with this private development. Okay, thank you. Well noted. The property that we're talking about is not in in is not right next to the designated property the city owns, which is a cultural art center location at this point. There they're probably about uh I don't know, probably a couple [3:00:31, 3:00:48]: I believe they're that far apart. So it's not it may not be directly it's not it's in the vicinity, but it's not really right next door. We'll try and measure it. Well male if I may. It's not continuous. It isn't continuous. [3:00:48, 3:00:51]: I i okay. I I'll just just get to the point. Okay. [3:00:53, 3:00:55]: This property that's in question. [3:00:57, 3:01:02]: It it borders on a vision of a city. I don't know how we can [3:01:04, 3:01:10]: Come forward with this development when there's a a vision already in place. [3:01:10, 3:01:11]: I think that [3:01:12, 3:01:17]: one should come before the other. So I'm not saying I'm against this project. [3:01:18, 3:01:20]: It but it's a process. [3:01:20, 3:01:23]: And my recommendation is to defer. [3:01:25, 3:01:26]: This project until [3:01:27, 3:01:29]: We have had opportunity. [3:01:30, 3:01:32]: To come back and discuss. [3:01:33, 3:01:35]: That particular area. [3:01:35, 3:01:38]: Іф ви динахав до [3:01:38, 3:01:39]: Mayor Pon Order. [3:01:40, 3:01:40]: Yes, ma'am. [3:01:41, 3:01:50]: Well you got a point of order? I do. Okay. Go ahead. Particular portion, um, um, with all respect, Councilman Thomas. [3:01:52, 3:01:59]: is real estate matters that may be executive session discussion. I I don't think that [3:01:59, 3:02:04]: we can go to the extent w I just think that it it's going too far. [3:02:04, 3:02:21]: Well Mayor Ford, I I'll just make a recommendation that we defer this project until we have further discussion. Good good. Appreciate it that's a re that's a recommendation. May I have a follow-up. Well any other uh any other comments for Mr. Anderson right now in reference. [3:02:22, 3:02:26]: Okay. Yes. Go ahead, please. [3:02:26, 3:02:44]: Okay, and in in terms of where we're going with this development, as I said, uh in relation to the other, this has primary access off of North Henry Boulevard, correct? Yes. Which the impact on traffic would be minimal. Y that's w yes, and that's what that's according to their traffic study too. [3:02:45, 3:03:04]: This particular development itself is consistent with the other developments that have been placed in the area, including the thirty foot setback, correct? It's basically essentially the same. So basically the precedent has already been set in this area for this type of development multiple times, right? [3:03:04, 3:03:17]: Yes sir. So basically your you basically you stated the developer would be given hardship and it would be put the city in a precarious legal position to be uh put in this position where we [3:03:17, 3:03:26]: Deny a development that is a sensitive. What's your point of order, please? Again, these discussions I think is executive sessions. So should we that's my whole purpose. [3:03:26, 3:03:37]: Okay, the point that I'm trying to make is that I just want to make sure that we're being oh sir, you're right about that. We're being fair to this particular development is what you said. Mayor Ford. [3:03:38, 3:03:58]: I move that we defer this agenda item until further notice. I second. Okay, what once I I got a question for attorneys. This is a pup this is a public hearing though. So that's the thing about it. This is a public hearing. So I I I'd you c but point of order. I want to get a legal opinion about this before we go [3:03:58, 3:04:07]: any further because this is a public hearing. So whether we defer or not, I don't know whether how we we c whether we can actually do that whether what it's been announced as a public hearing. [3:04:08, 3:04:08]: So [3:04:08, 3:04:14]: I need attorney to come forward some after come forward here and Mayor for a point of order. [3:04:14, 3:04:23]: that we and before we go, I I move that we recess and go into an executive session for about five minutes for real estate matters. [3:04:23, 3:04:31]: Hold m Mayor Ford, that there's a motion on the table. There is a motion, okay. I don't know whether it was seconded, that's true. Right. For discussion purposes, Samantha. [3:04:32, 3:04:42]: I need your legal opinion. Let me comment as she come forward. If if this council recall, it was a public hearing on another matter and we deferred that matter. [3:04:43, 3:04:45]: I I I just okay, I understand it. [3:04:46, 3:04:48]: Samantha, legal opinion here. [3:04:50, 3:04:55]: Can you state the question and super the motions are made to defer this particular issue. [3:04:55, 3:04:58]: And and I'm not going further with the conversation. [3:04:58, 3:05:18]: on this at this point and have and bring it up some up some of the later t time frame when it's been designated, but this is a public hearing. And so we have not we have it's a public hearing it's been announced at the public hearing. I have not opened the public hearing up thus far because we've gone going through discussion. So I just want to know if it's legal if we can legally defer this or we have to go process through the public hearing first before we think about deferring it. [3:05:18, 3:05:18]: Anything. [3:05:18, 3:05:38]: You can defer it, but you also need to repost the the public hearing and give the public an opportunity to speak on it if they don't get to speak today. Okay, so we can we can defer this time frame and then repost. Correct. And and I guess if we if we did that, but that was approved and we did that, then I guess in a sense it wouldn't be uh it can be post any time. It's not a time limit on this [3:05:38, 3:05:51]: Correct. I'm you can also let the public speak on and then defer the vote. So you have an option to do either one, as long as the public gets an opportunity to speak. [3:05:51, 3:06:10]: Okay. All right. Stand by for a second, please. All right. Motion has been made to defer this uh this particular issue on this on this particular discussion as been seconded by the uh account one second seconded it's been seconded. One second, it's been seconded by Miss Barber. Is there further discussion? Okay. [3:06:11, 3:06:18]: to hear from the applicant if this would for place undue burden for delaying the project'cause delays cost money. [3:06:19, 3:06:22]: All right. It's part of discussion purposes. [3:06:23, 3:06:36]: And who who is that's all I'm asking. Don't do that. I don't know who's the applicant. But that's not my issue though. It's too late. That's not my issue. [3:06:37, 3:06:57]: Mayor, I hear a mumbling while we're speaking. Okay, I understand. Name and address, please, sir. Yes, thank you. Uh Mayor and City Council, good evening. My name's Alex Brock with Smith Gambrel Russell. I'm here on behalf of the applicant, Forrestar USA Real Estate Group. Uh we would request that this body not defer uh the application. Uh one, the motion was unindefinite. [3:06:57, 3:07:17]: In its time frame for deferral. We do have contractual obligations with the seller of the property to move forward. That would put us in at issue with the seller for an extension of the contract. So we would request if there are issues that can be worked out here tonight. [3:07:17, 3:07:29]: uh that we do that during the public hearing and move forward with the vote on the application. Or I guess secondary, if you do defer the application a definite time frame of no more than [3:07:31, 3:07:31]: Thirty days. [3:07:33, 3:07:34]: Oh jack. [3:07:38, 3:07:50]: Yes, and that's another issue is you know whether or not this is pertinent to the application or the development itself. Uh it's not. Uh understand. Mayor. All right. Uh yes, yes, stand by sir. Yes, ma'am. [3:07:50, 3:08:10]: Thank you. And thank you for answering that question. Having said that, Mayor, I just really have something I really want to discuss with Mayor and Council in regards to real estate matters before we continue on with public hearing. And I'm asking that we break real quick, discuss this in five minutes with the attorney, and then come back and Okay, so you you you want to go on to the second session? Yes. So so wax so [3:08:10, 3:08:30]: Actually we have a motion already on the floor though. That's the thing about it. Okay. We already have a motion on the floor. It's been seconded. We're in discussion phase. Okay. Alright. So actually got as far as far as I'm concerned, we've got to finish that motion first before we go into another motion, unless the individual that made the motion withdraws the motion. Alright? So Mr. Thomas, do you withdraw, do you want to withdraw your motion? [3:08:31, 3:08:34]: All right. So motion has been made in the second. All in favor of the motion, please indicate. [3:08:35, 3:08:36]: All polls. [3:08:38, 3:08:41]: What do you s you sustain or you what w ye or nay or sustain? [3:08:42, 3:08:45]: rather go on the executive session. [3:08:47, 3:08:50]: A vote a against the mo against the motion itself. [3:08:50, 3:09:09]: Okay. I says the motion the motion current motion uh fails or fails uh three to two. So otherwise now that motion's failed. Ms. Gantt, you want to make a motion? Mayor, I move that we make a brief recess to go into an executive session for personnel m I mean for real estate matters. All right, sir second that motion. Second. Okay, all in favor, please indicate. [3:09:11, 3:09:18]: Okay, I'll oppose. Sustain. Four zero one. Motion passed. Ladies and gentlemen, we'll be back from the Zechosex just a bit. [3:10:00, 3:10:20]: motion to end the executive session please. So move. Is there a second? Second. Uh Mr. Barr uh Mr. Berry second from Alexander Berry. All in favor please indicate. I need a motion to uh get back to our uh council meeting in a public hearing please. So move. Is there a second? Second. Mr Berry second that as well. All in favor please indicate. All right, and we have nothing to uh sense to [3:10:20, 3:10:39]: uh spow to the public is on a point from executive session that we had about real estate. So what will Ryan, you were up here last. Come back please. If there's anything else that you need in reference to the the actual variance for rezoning or the comprehensive plan change. Anything else you need to add at this point? No actually I was finished ma'am. [3:10:40, 3:10:56]: Okay. On that note that if you were finished, sir, then I will open up the public meeting. Uh public hearing I should say, the public hearing. The applicant. I'm sorry? I'm sorry, the applicant you're right. Thank you, sir. The applicant you need to come forward. I'm sorry. So you need to come forward and and brief us on anything else you need to add, I'm sorry. [3:10:57, 3:10:57]: Good point. [3:10:59, 3:11:00]: Thank you, Ryan. [3:11:01, 3:11:06]: Uh and if you could give me a moment to I'd load my presentation. Yes, sir, lo load it up, sir. No problem. [3:11:10, 3:11:10]: Uh now I got [3:12:00, 3:12:02]: Okay. Yeah, go right, please. Okay. [3:12:02, 3:12:16]: Good evening, Mayor and City Council. My name is Alex Brock with Smith Cambrai Russell, Office of Addresses, 1105 West Peachtree Street, Atlanta, Georgia. I'm here on behalf of the applicant, Four Star USA Real Estate Group. Joining me tonight, I have Jack Burke and Ren Giazzani with Four Star. [3:12:17, 3:12:26]: Uh we are here to discuss our application for a comp plan amendment, rezoning, and one variance for a 90-unit townhome uh development on North Henry Boulevard. [3:12:27, 3:12:34]: Planning staff gave a lot of the background facts or factual information, so I will not reiterate a lot of what they stated, but there are a few [3:12:34, 3:12:42]: pertinent points that I wanted to uh go back over and point out, and then uh spend more time on the uh development itself. [3:12:47, 3:13:07]: The rezoning, as staff noted, we are asking for a rezoning of the uh property. It's uh currently a mix of OI, C1, and uh suburban residential. We are requesting rezoning to multifamily residential uh to provide for the 90-unit townhome development. Uh the 90 units would equate to a density of five. [3:13:07, 3:13:10]: [11590.9, 11610.9]: Which is compatible and commiserate with what's in existing in the area today. You can see on the zoning map that I have pulled up that to the east of us, we have the Oak Hill townhomes, which are zoned MFR, which is the same zoning that we are seeking tonight. That development is at a density of 6.67 units per acre. Uh to the north of that, you have the [3:13:30, 3:13:36]: Turning point subdivision, uh which is at a density of eight point zero seven units per acre. [3:13:37, 3:13:55]: To the north of our property is an undeveloped parcel owned by the city of Stockbridge. To the uh west are uh single-family residential lots, uh zones uh suburban residential within along Club Drive and Club Place. Uh to the south is a mix of uh aging commercial along North Henry Boulevard. [3:13:56, 3:14:08]: And just to reiterate, our proposed density of five point seven six nine uh is actually below what is existing in the area today for the uh MFR uh developments. [3:14:10, 3:14:30]: Along with our rezoning, we are also asking for a comp plan amendment. The property is a mix of low density mixed use along the North Henry Boulevard parcels and medium density residential for the larger portion to the north. We are asking for a uh singular uh uh comprehensive land use. [3:14:30, 3:14:35]: use plan d uh designation of medium density residential for the entire development. [3:14:36, 3:14:56]: Uh and we are also seeking one variance. The variance uh is for the front yard setback. Uh the city earlier tonight had proved a similar uh variance for the other application. We are only requesting a reduction from 50 feet to 30 feet. Uh in that is just due to the shape of the property, it's a long narrow. [3:14:56, 3:15:06]: narrow property, so we are confined by the sides, but it also provides a number of benefits to not only uh the the future residents, but also the existing residents in the area. [3:15:07, 3:15:08]: The reduction of setback [3:15:09, 3:15:19]: allows us to push these units closer to the center and away from the existing residential on either side of the property. Uh that allows more buffer against the adjacent existing residential. [3:15:20, 3:15:40]: Uh and also it reduces the maintenance uh of the landscaping for each of the units with smaller front yard. These will be fee simple townhomes. We'll have an HOA. Uh four stars, one of its components of uh its HOA provides for landscape maintenance, not only for the common areas, but also for the units themselves. So the smaller front yard. [3:15:39, 3:15:59]: Yards lead to a smaller maintenance fee. It also translates into a lower HOA fee for the residents themselves. One of the negatives of that would be reduced parking in the front driveway, but we are still providing 30 feet of driveway, which is more than enough to accommodate a vehicle. [3:15:59, 3:16:02]: [11763.1, 11781.3]: uh adding guest parking throughout the development uh and we are well over the required uh minimum uh parking for the city of stockbridge UDC. Uh Stockbridge requires a minimum of two point two five uh spaces per unit. Uh we have approximately three point one uh spaces per unit. [3:16:23, 3:16:43]: In the proposed development, I'm gonna spend a little bit of time talking about that uh and then get into staff's recommended conditions. But the proposed development, as I noted, consists of 94 sale townhome units with amenities. All units will be three bedrooms. Uh we are preserving approximately 4.8 acres of the site as open space. Uh that translates into 30% of the overall property. [3:16:43, 3:16:56]: property as open space. The Stockbridge UDC only requires 15%, so we're almost double uh on the amount of open space that we're providing. And it to that point [3:16:57, 3:17:16]: The density, the number of units, and the amount of open space that we are providing, we are not trying to max out what we can get under the uh proposed zoning uh or the land use plan. We are we are trying to pr uh propose a development that is fitting for the community, fitting for Stockbridge, and compatible with the surrounding uh [3:17:17, 3:17:20]: uh i existing residential developments. [3:17:20, 3:17:21]: Yeah. [3:17:22, 3:17:34]: The amenities that we're proposing, we are providing a pool, a clubhouse, uh, and dog walk area, uh, in addition to the large amount of open space throughout the development. [3:17:34, 3:17:54]: These amenities are something that the this body has brought up before on previous rezonings that FourStar has had uh within the city. Uh so we decided to from the start provide those amenities. Uh again, just to reiterate the stockridge UDC does not require amenities for uh developments under 100 units, uh, but we are providing uh a [3:17:54, 3:17:56]: Uh three of those amenities. [3:17:57, 3:18:17]: In addition, another lesson that we learned from uh previous rezonings is community engagement. Uh we reached out to the community and held a community meeting on January 24th via Zoom. We had approximately 10 participants uh from the uh surrounding uh residents. Uh and then we have received some [3:18:17, 3:18:25]: Several phone calls from other residents subsequent to that and subsequent to the Planning Commission meeting. [3:18:26, 3:18:32]: Here you can see an example of the proposed architectural of the two home garage or two car garage uh homes. [3:18:33, 3:18:37]: And here's a example of the one car garage homes. [3:18:39, 3:18:59]: Here are the proposed staff conditions that Mr. Anderson uh had gone through uh previously. And there's one we are in general agreement with what staff is proposing. There is one condition that we would like to discuss with the the city, uh just so that everybody's on the same page. And that is in regards to the mix of one-car and two-car units. Uh the reason why we're providing a mix. [3:18:59, 3:19:19]: Mix of units is not for cost of the development. Uh developing one car garage versus two car garage unit is uh not any sub it's not substantially different. But it does provide a boost in marketability and broaden the appeal to a a wider range of market uh of buyer for this this uh type of home. [3:19:19, 3:19:39]: Uh four star from their experience has noted a high demand for the one car garage types of units. And that that is primarily focused towards the entry level buyer, uh someone that is you know, your recent college graduates uh that have a home. They're not married yet, so they have a single car uh in a one car. [3:19:39, 3:19:42]: Garage fits that need. [3:19:44, 3:19:51]: And it it fills a number of uh goals of the city's comprehensive plan as well. Uh the city's comprehensive plan [3:19:52, 3:20:12]: Notes the need for high quality product and a diversity of housing. Uh there's a number of quotes in the comp plan. I just wanted to read a few. Uh that the housing options available uh to accommodate lifestyles, whether it be young professionals looking for low maintenance options, growing families needing space, or empty nesters looking to downsize. Uh another goal would [3:20:12, 3:20:26]: Be to provide a variety of housing choices to suit the changing needs and lifestyles of city residents and to provide additional housing in the downtown downtown core. Now we are just outside of the downtown core, but we are we are close to that. [3:20:28, 3:20:37]: And again, our option for providing these range of units just increases the marketability and the uh diversity of the buyers that that would uh come to our development. [3:20:39, 3:20:59]: So we would urge the city council, uh staff has recommended a uh condition of eighty percent two-car garage, uh twenty percent one car garage. We would be more comfortable if it was closer to a sixty-forty uh split. Uh right now we currently have forty-three uh one car garages and forty-seven uh [3:20:59, 3:21:00]: Uh two car. [3:21:02, 3:21:22]: So with that, I will end my presentation. Uh as I note I'm close on time and reserve any remaining time for rebuttal. Okay. Thank you. One second, please. Uh okay, so I guess we'll get an idea whether or not the council is willing to deal with the sixty forty that uh rest r car aspect that you asked for or asking for. Um I forgot, did I miss the square footage? You said [3:21:22, 3:21:27]: It's three bedroom it's uh they range between fourteen hundred to two thousand square feet. [3:21:28, 3:21:33]: Are all three bedrooms you said, right? That's correct. Okay. And the cost factor you're looking for? [3:21:33, 3:21:47]: Uh it would be mid mid three hundreds. Okay. All right. Um um Miss Gad, go ahead please. Thank you. Um I was gonna ask if you can have all all two car garages. I really don't [3:21:48, 3:21:49]: Like [3:21:50, 3:22:09]: think that that's something that's I don't think that's within the vision of what we want here in the downtown area. I would and I was gonna ask maybe if the garages were in the back of the facil the back of the house instead of right there in the front. Um I know that's things that we they're gonna talk about later, but [3:22:10, 3:22:30]: I would prefer two car garages all the way across. Like I just um I have a concern about one car garage homes in this area. I don't think that's something I was really interested in at all. Okay. No and and I note your your concern and again it goes back to uh [3:22:30, 3:22:50]: If I can show the site plan. Just a variety of the housing. Uh four star just in their other developments has uh had a demand for the one car garage units because it is a entry level unit and it does provide a lower uh price point uh for entry. Well I can understand that, but originally I didn't hear the lower price point discussion. I heard [3:22:50, 3:23:10]: Because it's an entry-level home and it's single person. And I don't know about many people, but I think a single person wants as much as they can get out of it, right? As much space as they can get out of that particular that that unit. And um, you know, if all of them were three bedrooms and a four. [3:23:10, 3:23:16]: fourteen hundred square foot. That's real tiny. Tiny. And so I I would prefer [3:23:17, 3:23:22]: Um, that every house has a two car car garage. That's my opinion. [3:23:24, 3:23:26]: Yeah, go ahead, Mr uh Mr Alexander. [3:23:26, 3:23:46]: Honestly I kinda concur with that. I was uh and that's been consistent with what we were trying to do is have the two car garages be throughout. One of the things we're trying to do is to be consistent and not because we have an established subdivision, McCain Creek, which is very close across the street, we wan those values we don't want to make what make [3:23:46, 3:24:06]: sure that we do everything possible to maintain those values and the two-car garages uh actually help us to uh maintain the values uh on these particular homes. Now certainly as we're looking forward to do what we're doing uh you know uh there is an entry-level housing need and that's why [3:24:06, 3:24:26]: Why we've been flexible in not requiring the units to be 100% brick. Because we were required, um, the townhomes that are built down the street from me, they're basically four-sided brick. They have some, maybe a few feet at or some at the top, they have some uh hardy plank or that concrete siding, but they all they're [3:24:26, 3:24:46]: Brick all the way around. And there wasn't any flexibility on that. Miss Gannis talked me into having some flexibility on that, which actually does help with the cost of that by not acquiring brick on absolutely all of them. But to be consistent with what we've done in every other development. [3:24:46, 3:24:48]: development we require two car garages. [3:24:49, 3:24:50]: Not if I may. [3:24:51, 3:24:53]: Are you gonna say something, sir? Yes, okay. [3:24:54, 3:25:13]: Oh um I would I would just add if there is some flexibility on some of the other uh conditions that staff has proposed, like the break uh I think we're just kinda where we are, sir. You know it's been a long night already, but the city's kinda pretty been pretty tight on what uh we expect uh from this particular development. I do have a question. [3:25:20, 3:25:20]: I will hear those. [3:25:25, 3:25:27]: My apologies, I was conferring. [3:25:27, 3:25:38]: It certainly we want to make sure that we're doing everything the possible to make this a uh quality development. So uh as was that what's gonna happen to the prop the business that's on site now? It's going away. [3:25:39, 3:25:55]: The mortuary we are not the current owners of the property. Uh they are under a lease agreement. I don't have the details of that lease and I'm not Okay, I'm saying once you well, I'm just saying if the you are the owner of the property, then pretty much at that state it it would be [3:25:56, 3:26:16]: Yeah, it w I mean it would be developed. That's correct. The mortuary would go away, but uh again, we are not the uh tenant uh oh well absolutely understand understanding that is that pretty much it it would be redeveloped as a part of this particular project. One of the things we've have endeavored to do is change the appearance. [3:26:16, 3:26:36]: of North Henry Boulevard. Some of the older 1966 structures are gonna have to come down in order to improve that. So redeveloping that property with uh basically this is gonna be a gated community, so there will be a gate there and there will be a 10-foot multi-use path replacing [3:26:35, 3:26:41]: the five foot sidewalk that would impact your property along the entire frontage, is that correct? [3:26:41, 3:27:01]: I that I don't believe that was in conditions, but we're willing to accommodate that. Absolutely. We are with every product that we have come forward, we're requiring a ten foot path because we want to have that path be throughout this particular city, everywhere we go, any new development. And the only way to have our trail be consistent is to make sure every new development [3:27:01, 3:27:19]: as they come forward. I appreciate the fact that you come by y'all have come forward and you want to help us to revitalize this corridor because that's exactly what we're trying to do is to revitalize that corridor. So every last one of those buildings that can come down certainly would be a plus for all of us. [3:27:20, 3:27:27]: Gentlemen on this side, you guys an anybody else any comments uh for the for the applicant right now? Okay. Miss Barber, you have a comment? [3:27:28, 3:27:29]: Yes. Um [3:27:30, 3:27:37]: I certainly would prefer to see all two car garage units, not one car garage. This is in my district. [3:27:37, 3:27:50]: So um the complaints and concerns from residents who live in the area about on street parking, I wanna eliminate it or minimize it as much as possible. I believe one car garage is will [3:27:52, 3:27:53]: It will. [3:27:53, 3:27:55]: bring forward people. [3:27:56, 3:27:58]: parking along the streets and we don't want that. [3:27:59, 3:28:03]: The other is um I want to know where are the entry points. [3:28:04, 3:28:18]: to this development. It is on North Henry Boulevard. Uh the one drive that you see here that goes out onto Club Place is emergency access only and that's required by fire code for firetruck access. That will be gated with an Oxbox. [3:28:20, 3:28:24]: I'm sorry I can I can't see that clearly. Let me see if I could oops. [3:28:26, 3:28:28]: I don't know if I can zoom in. [3:28:29, 3:28:43]: The commercial well, right now that commercial piece, um, there's a slope or a hill. So I'm trying to figure out how would they enter into this proposed development. Would they be using Center Street to access it? [3:28:43, 3:28:49]: No, this it the access would come off of North Henry Boulevard here at this location. [3:28:52, 3:28:53]: Are you [3:28:54, 3:28:55]: Okay. [3:28:56, 3:28:58]: So then that's the entry. [3:28:58, 3:28:59]: Currently. [3:29:00, 3:29:02]: That's there for the mortuary. [3:29:02, 3:29:06]: The mortuary is a little bit further to the east, but yes, it's roughly in the same location. [3:29:07, 3:29:08]: Okay. [3:29:09, 3:29:21]: Okay. One of the concerns that I have is that um we are endeavoring in redeveloping our downtown. This is within our redevelopment plan for the downtown. [3:29:22, 3:29:24]: The forward facing [3:29:24, 3:29:25]: Um [3:29:26, 3:29:27]: Commercial peace. [3:29:28, 3:29:32]: I'm concerned about that because the whole purpose is to attract [3:29:32, 3:29:33]: Businesses. [3:29:34, 3:29:39]: So with this proposed development, including the commercial piece. [3:29:39, 3:29:42]: to construct residential and us having to [3:29:42, 3:29:44]: Change the rezoning. [3:29:45, 3:29:46]: That takes up [3:29:47, 3:29:50]: Commercial areas where businesses could go. [3:29:51, 3:29:54]: So I don't support rezoning. Um [3:29:54, 3:30:02]: I'm not against um the development because the undeveloped area along Center Street um [3:30:02, 3:30:06]: I mean it's buildable land, but I'm just concerned about the commercial piece. [3:30:06, 3:30:10]: I don't particularly support changing the land use designation. [3:30:10, 3:30:12]: From commercial. [3:30:12, 3:30:13]: to multifamily. [3:30:14, 3:30:18]: Mainly because the whole point is for us to attract businesses. [3:30:19, 3:30:19]: That's all. [3:30:20, 3:30:23]: You know any other comments from the council before we open up public hearing? Okay. [3:30:24, 3:30:28]: Sir, thank you very much. So I open up the public hearing. Uh one second. [3:30:31, 3:30:38]: Do you have something else you need to add right now, sir? I'm sorry. Um if could you give me one moment to Sure, go ahead. Go ahead before I open it up. [3:30:40, 3:30:40]: Come on. [3:30:43, 3:30:44]: I don't want marsh over there. [3:30:53, 3:30:56]: Can we ask one question of uh Go ahead. Mayor and City Council. [3:30:58, 3:31:14]: In looking at the uh the two car garages, it is a little bit wider units, twenty four units or twenty four feet versus twenty foot unit. So we will have to revise the site plan and uh Mr. Anderson noted that at the beginning of his presentation that the uh the first condition is contingent upon site plan approval, but [3:31:14, 3:31:16]: in general conformance. [3:31:16, 3:31:36]: One thing that we are looking at in order to accommodate some of that with and move some of these units around is to remove some of the guest parking uh and potentially uh remove or change some of the amenities. I just wanted to see if city council was amenable to that requirement or that that option. But when you say change am change amenities, what are you talking about? [3:31:36, 3:31:37]: [12697.5, 12700.9]: Removing the clubhouse, uh the pool area. [3:31:41, 3:31:42]: Or just the pool? [3:31:43, 3:31:47]: Just removing the pool area uh from the b from the front. [3:31:47, 3:31:51]: I don't think we would want to do that. [3:31:52, 3:32:12]: Oh I guess. I I don't know. Council what do you think about that? No okay, I don't think we're favoring it court removing any of the amenities. The whole point is to help us redevelop. So we're looking for unique products, something different than what we currently have. So having the pool and clubhouse is an amenity. [3:32:12, 3:32:15]: That we would need for this. [3:32:17, 3:32:24]: We're amenable with the two car garage. You said what now? We're agreeable to the two car garage. Okay. [3:32:25, 3:32:26]: Good deal. Appreciate that. [3:32:27, 3:32:34]: With the pool and everything still attacked. With the pool uh except for some of the guest parking we may have to remove just to move things around. [3:32:36, 3:32:39]: Yeah, we won't need it with the additional parking. [3:32:40, 3:32:47]: So we're gaining Excuse me now. We we're we're gaining forty seven spaces in the driveway uh by adding a two car garage. [3:32:48, 3:32:50]: Yeah, right. [3:32:53, 3:32:54]: I don't see. [3:32:54, 3:33:06]: And then the pool is is a real that identity that they will be adding to the location. So Berke's trying to get his attention. So m my concern is you're gonna reduce the guest parking then, is what your plan will be? [3:33:07, 3:33:17]: Well no, we're just moving the guest parking from the onsite space. He may he seems they they wanna talk. I don't mind them coming on up instead of trying to relate. [3:33:17, 3:33:26]: I mean produce ourselves. If you j you jump and come come up here and produce they can come up with their attorney and help us out here and kinda explain what they're doing. [3:33:26, 3:33:29]: Good evening, I'm Jack Burke with four stars, thirty-three. [3:33:30, 3:33:33]: Zero, Cumberland Boulevard, Atlanta, Georgia. Um [3:33:35, 3:33:50]: I just wanna make sure we're we're understanding correctly. We're we came here tonight and we're talking about conditioning the property to have all two car garage, correct? Yes. And removing the one car units, correct? Yes. If we're if now [3:33:50, 3:33:56]: All these units are two car garages. We just gained some parking in the driveway, correct? [3:33:57, 3:34:03]: Is there need for the we and and so the way we had initially designed this was providing extra [3:34:03, 3:34:18]: parking throughout the community to combat a one car garage that has less parking per unit. Now if they're all two car, do we need this extra parking? And and we'll keep the we will keep the parking for the amenity center just [3:34:19, 3:34:39]: We're just asking, is there a need for parking between the units as shown on the site plan? Doesn't seem like there is most people gonna prefer to park in front of their unit where they live. Uh I I I've lived in a condo before. My sister currently lives in a condo and when you have public parking, a lot of times when people are visiting you. [3:34:39, 3:34:39]: Mm. [3:34:40, 3:34:45]: It's for something festive, like a holiday event or whatever. People don't like to lug things. [3:34:46, 3:35:00]: blocks away from where they're going. And so that concept never really works in pract being practical. When people live in condos and townhomes, it it just doesn't work. It's a it's a nice to do, but it doesn't really work practically. [3:35:00, 3:35:17]: I I guess what we would be asking is there guidance on how many parking spots per unit need to be provided as proposed or exceeding the ordinance. Um I think if we then add more parking in the driveway. [3:35:19, 3:35:24]: You know, we're greatly exceeding the ordinance. I I'd um we're just looking for counsel on some guidance on [3:35:26, 3:35:29]: How many how many park parking spaces per unit? [3:35:29, 3:35:32]: Do we need here in st in Stockbridge? [3:35:32, 3:35:52]: Um what we provoke proposed again exceeds the ordinance and very much mi mirrors rezonings that the planning commission and council approved in May. So uh um and real quick You can't exceed the uh the the required parking by no more than twenty five percent. [3:35:53, 3:35:56]: You can't exceed by twenty five percent. More than twenty five percent. [3:35:57, 3:36:03]: Okay. So you gotta cut some of'em back, is what you Yeah, they need to reduce the number of parking if you make all of them two car garages. [3:36:03, 3:36:16]: Okay. But we we definitely want parking near the amenities, right? You would keep those just that other extra part you wouldn't have to have because people want to part where they live. We might not need it all. [3:36:16, 3:36:19]: Yeah, exactly. Yeah, we might not need it all. [3:36:19, 3:36:21]: Based on this plan. [3:36:22, 3:36:32]: Right, the site plan that I have pulled up where my cursor is, these little spots in between the units. Yeah, we are starting to do overkill on the parking. Yeah, now real quick, how let's talk about the frontage. [3:36:32, 3:36:41]: North Henry Boulevard. How much of that what's the expansion? What how many feet is that of frontage on from on North Henry that you guys are putting right there? [3:36:42, 3:36:57]: What's the the frontage frontage of the frontage of North Henry Boulevard? Like our main arterial. Right? That's correct. So they would have to go up this slope. [3:36:58, 3:37:00]: To get into the subdivision. [3:37:01, 3:37:10]: And how wide is this front edge space? So is it one block of space, two blocks? Because Councilwoman Barber mentioned, you know, [3:37:10, 3:37:23]: She vision envisioned that frontage is for commercial properties. So I'm trying to figure out how much of this frontage are you guys taking up with a residential property. But are you talking about which ones are commercial? [3:37:23, 3:37:29]: No. No. North Henry Boulevard. What's the width? What's the width? [3:37:30, 3:37:31]: The measurement. [3:37:32, 3:37:33]: How many feet? [3:37:33, 3:37:34]: A frontage. [3:37:34, 3:37:54]: Yes, uh this is Renato Ghizzoni, uh director entitlement's a four star at three three three zero Cumberland Boulev Boulevard Suite two seventy five Atlanta, Georgia, three zero three three nine. Um I estimate it's about five hundred feet, maybe five hundred and fifty of frontage along [3:37:55, 3:37:57]: North Henry Boulevard. [3:37:57, 3:38:01]: We do not propose any units facing North Henry Boulevard. [3:38:01, 3:38:11]: the units face the internal road as you come in the property through North Henry Boulevard. Did did I answer your question? And to answer the question about uh the slope? [3:38:11, 3:38:12]: That is something that [3:38:12, 3:38:29]: we'll develop according to city code for the slope of the road. So, you know, it's not gonna be a mountain slope, it will be the slope that is per city code. And it is possible to grade to city code as it's um currently shown right now. [3:38:31, 3:38:51]: Right. That's answered your question. Ms. Alzheimer, you must have something else? Yeah, I just want to make sure that that slope or whatever else is part, Ryan, is part of the beautification plan, is not just left in that condition that whatever it is that holds slope is part of the beautification plan. [3:38:51, 3:38:53]: With trees and shrubs and plantings. [3:38:54, 3:39:14]: Yeah. It will be graded. They would have to go through when they put submit their silver plants near Topo, we'll decide on how much grate to get that slope down. So it won't be a hill like it is now. Right the but I'm saying whatever it is, it needs to be there needs to be beautification and trees and yeah, landscaping and all that yeah that that's that that would that's required. Or the highway. [3:39:14, 3:39:22]: Yes, sir. Yeah. That's that's mandated. I'm sorry, Mr. Thomas. I'm I'm I'm sorry, sir. Did you good? Okay. All right. All right, Miss Barber, go ahead, please. [3:39:22, 3:39:33]: We're this is a public hearing and the public has yet to be able to do it. Pay attention this I haven't opened up. [3:39:33, 3:39:34]: I don't like that. [3:39:35, 3:39:40]: I wanna wait until I hear from the mem members of our community. [3:39:40, 3:39:48]: before I speak on whether or not I will support this. But we're talking as though this has already been approved. [3:39:48, 3:39:49]: I don't like that. [3:39:50, 3:40:10]: Alright, any anybody else have any other comments? Okay. Okay, we'll open up for public hearing now. I'm pretty sure we'll have you come back up in a little bit. Okay. Open up the public hearing. And uh with all in favor of favor this development, positive comments, favorite comp uh this development. It looks like my very left side, all right, in the very middle. [3:40:10, 3:40:14]: Any pa positive inf influential, positive comments. [3:40:15, 3:40:26]: On my far right side, any positive comments for this development? Okay. Any negative comments, comments that uh did you want license to deny or or more discussion or whatever the case may be? On my far left. [3:40:26, 3:40:33]: In the middle. Any comments in the middle. Okay, so what what I'd like for you to do is line line up on line up on that side. Line up on that side. [3:40:34, 3:40:46]: Okay, line up on that side. Anybody have negative comments in reference to this development from the middle? How about from the far right side? Far right side. Any negative comments that you want to make about this development on the far right side? [3:40:47, 3:40:48]: Okay. [3:40:48, 3:41:05]: Okay. Uh uh come on up on the line up on this other side please if you have any negative comments or comments that you wanna make. Mayor. Uh yes ma'am. I'm I'm sorry, I was trying to get your attention before that. I'll if and if I may, Councilwoman Barber, I wanna apologize. I don't want you to think I've made a decision on anything. [3:41:06, 3:41:26]: I don't think any of the council members have made a decision on anything, but because it was their turn to explain, we were trying to get an idea of, or at least I was, of my options just in case we do approve it. We've already knocked that part out of the way. We're getting late into the hour, so we were trying to make sure that we get as much [3:41:26, 3:41:27]: much information as we can. [3:41:28, 3:41:48]: on that end before we listen to the opposing side. I have no problems with being um fair and make sure that you know we're doing this right and that I just want you, the constituents to know we have not made up our minds. This is just things that we would want to see if we decided to approve. [3:41:48, 3:41:53]: approve it, but we are gonna listen to both sides and I do plan on always remaining fair and partial. [3:41:54, 3:42:01]: So otherwise on that note, public hearing once again is open up. So if I can respond, please. Um once again. [3:42:02, 3:42:06]: Whenever there are public hearing items for city council district four, um [3:42:08, 3:42:10]: This council seems to just take over. [3:42:12, 3:42:24]: We're having all these discussions before we even hear from the public. I understand the process. I know the process. It just seems like it changes every single time there's a proposal. [3:42:25, 3:42:27]: that is presented for City Council District Four. [3:42:28, 3:42:37]: This council shouldn't be having all these discussions before the public does. I know that the developer, their attorney, has to do their presentation. [3:42:38, 3:42:41]: Now what are we gonna do? Once the public [3:42:41, 3:42:43]: They make their comments and [3:42:43, 3:42:54]: Then you're gonna ask the staff come back up. You're gonna ask the developer and their attorney to come back up. Then we're gonna go into this whole blown out, long discussion all over again. [3:42:57, 3:43:01]: Please be consistent with these public hearing items. [3:43:02, 3:43:08]: Every single time these proposals are presented to city council district four, things just change. [3:43:09, 3:43:10]: Thank you, sir. [3:43:10, 3:43:17]: You're welcome. Um, madam clerk, when f late first person speaks, please start the clock. Ma'am, come on up and for your name and address, please. [3:43:21, 3:43:41]: Good afternoon. My name is Charlene Johnson. I live at 122 Turning Point, Stockbridge, Georgia. I want to say a little something first why I moved to Stockbridge, Georgia. I came here, graduated from Marshmallow College. [3:43:41, 3:43:43]: Was living in Stone Mountain [3:43:43, 3:43:53]: I worked two jobs and I made sure I saved my money and I rolled all over Georgia to find the right place for me to live. [3:43:54, 3:43:56]: And I bought my home. [3:43:56, 3:44:16]: And Stockbridge. Why? Because I read about Stockbridge. I study. I don't have my son is 36 now. I'm 60. And I'm happy where I live at. And this home was my home since this they built these homes 1997. I bought this home 16 years ago. [3:44:16, 3:44:36]: My home was 110. Right now, the value of my home is 380. And I'm trying to get it more. So when y'all are talking about putting a townhouse development in our backyard, 90, and you saying some might be [3:44:36, 3:44:54]: One garage, car garage, some might be two, you're talking about our value now. So when you do that, you're talking about the value of our home that we bought these homes to live because we love our neighborhood. First of all, let's talk about the traffic. [3:44:55, 3:44:58]: The traffic this morning I left. [3:44:59, 3:45:16]: out at seven. I didn't get to work till eight oh five. Why? Because it was raining and traffic is always up North Henry Boulevard. Always. You can go on a Sunday. I go to church, I get out on Center Street, I make a left, I have to wait. [3:45:16, 3:45:18]: There's no light there. [3:45:19, 3:45:39]: So the traffic if something if we having a concert here at the um amphitheater, we have traffic. The other day we had traffic. I don't know what the traffic was. I live on this side. I couldn't get over. I had to go all the way around um Food Depot to get back to my home. So let's [3:45:39, 3:45:40]: Let's talk about ninety more [3:45:41, 3:46:01]: um town townhomes coming in our backyard traffic okay let's talk about when he said single woman single parents are single people living in a townhouse with one car garage like the um the the council said she said if [3:46:01, 3:46:03]: If you single you still want more. [3:46:04, 3:46:10]: You d you can't just say'cause I'm single, I want a one car garage. That's not fair. [3:46:10, 3:46:17]: Well, let's talk about our neighborhood back here in turning point. Quiet, peaceful, no crime. [3:46:17, 3:46:22]: Put this there, rank these there, we're gonna have crime. [3:46:23, 3:46:34]: I'm telling y'all, we don't have no crimes back there. We know everybody. Now let's talk about this fence. How tall the fence is gonna be. Y'all never mention that. [3:46:36, 3:46:40]: Commercial, I thought that was a commercial development. [3:46:44, 3:46:55]: When you said you had a Zoom meeting, you call, I don't think you had my number, I didn't get no call, I didn't get no invitement. [3:46:55, 3:46:58]: Invited to the Zoom meeting. I would have been glad to [3:47:02, 3:47:07]: I'm just I'm just kinda upset because I just heard of this. [3:47:08, 3:47:11]: And you talking about ninety. [3:47:11, 3:47:14]: We don't have ninety homes back there. [3:47:14, 3:47:21]: The crime rate is going to go up. I pray that y'all are listening to us. The crime rate is going to go up. [3:47:22, 3:47:34]: You talking about renting some of these. You talking about buying some of these. So when you rent these, people who don't pay their mortgage on time, you're gonna put them out. So then we're gonna have back and forth, back and forth. [3:47:37, 3:47:43]: Thank y'all for listening. Thank you. Appreciate it. Um Ms. Sprayberry, name and address please. [3:47:46, 3:47:55]: Mayor Ford, Council members, my name is Kenneth Wayne Sprayberry. I live at 103 Turning Point Subdivision. I have been there 27 years. [3:47:55, 3:47:58]: I'm probably one of the most outspoken persons our neighborhood. [3:47:59, 3:48:02]: Forgive me, I'm gonna call it the way I see it. Don't mean to offend nobody. [3:48:03, 3:48:06]: Well, we're gonna get in there now was ninety [3:48:06, 3:48:07]: Town homes. [3:48:08, 3:48:09]: The wildlife is gone. [3:48:11, 3:48:13]: The traffic on Central Street is gonna be terrible. [3:48:14, 3:48:16]: Like my neighbor said, crime's gonna go up. [3:48:17, 3:48:20]: There's no mention on the site plan about a fence. [3:48:22, 3:48:25]: That's a easy pathway from the town home straight into our subdivision. [3:48:26, 3:48:27]: There is an easement. [3:48:28, 3:48:29]: Directly behind my property. [3:48:31, 3:48:33]: That ease would go straight into the woods. [3:48:34, 3:48:36]: It's a city of stockbridge easement. [3:48:37, 3:48:39]: I can't put a fence up there, I can't block it. I could. [3:48:40, 3:48:44]: But if y'all ever take notion coming to do work, it's gonna be tore down. I understand that's why I never did it. [3:48:46, 3:48:48]: Ам аскін я, пліз, листен до вас. [3:48:49, 3:48:51]: Yeah, thing is on commercial. [3:48:52, 3:48:54]: Time about so seven to ten minute clock? [3:48:56, 3:49:01]: Okay, I'm sorry to go ahead, so I'm sorry to interrupt you. That's okay. Um it was it was zone commercial? [3:49:02, 3:49:06]: That's what it needs to be. If you look along the entire front of North Henry. [3:49:06, 3:49:07]: There's no town homes. [3:49:08, 3:49:09]: There's no two homes at all. [3:49:11, 3:49:15]: You look across the subdivision, you got the subdivision across there, but it says back back off the road. [3:49:16, 3:49:19]: You go down looking at this the side plan. [3:49:20, 3:49:24]: Where the water goes down the hill. The water will go down the hill. [3:49:24, 3:49:29]: I fought for years about a water problem on my property. I finally got to see a stop bridge to take care of. [3:49:30, 3:49:31]: This water's gonna go straight down. [3:49:32, 3:49:34]: Back into the back of our soul division. [3:49:35, 3:49:36]: Down toward Brushy Creek. [3:49:37, 3:49:38]: If you go back here now. [3:49:39, 3:49:40]: Ya ugye chance. [3:49:41, 3:49:44]: Ride down Davis Road. Go around P Clark Park. It's our park. [3:49:45, 3:49:46]: Look in the trash. [3:49:47, 3:49:50]: That gathers from the storm water that goes back here. [3:49:52, 3:49:53]: I have talked. [3:49:54, 3:49:56]: To Mr. Gardner, he's had people go back and clean it up for. [3:49:57, 3:49:59]: Trash is gonna go through the stormwaters. We all know that. [3:50:00, 3:50:03]: Now you got ninety units storm water going back here now. [3:50:04, 3:50:06]: What impact y'all think that's gonna have? [3:50:08, 3:50:10]: It's gonna br it's gonna have an impact on everything. [3:50:10, 3:50:12]: Our subdivision is gonna be a swamp land. [3:50:13, 3:50:17]: My neighbors in the very back of our subdivision, they won't have a backyard, they're gonna have a swamp. [3:50:19, 3:50:20]: That's not fair. [3:50:22, 3:50:23]: Leave it. [3:50:23, 3:50:24]: Commercial [3:50:25, 3:50:26]: Leave our subdivision alone. [3:50:27, 3:50:31]: We like sitting outside. I moved there, raised my kids there. [3:50:31, 3:50:34]: I love setting my fence in the backyard, getting out early in the morning. [3:50:35, 3:50:39]: Drinking my coffee, watching the deer, listen to peace and quiet. [3:50:39, 3:50:40]: That's my lifestyle. [3:50:42, 3:50:45]: Now I got townhomes, I'ma walk out my backyard. [3:50:45, 3:50:46]: Hey [3:50:47, 3:50:48]: Hope you don't come rob us. [3:50:51, 3:50:54]: Do the right thing. That's all I'm asking y'all. Do the right thing on this. [3:50:55, 3:50:59]: Thank you all. Thank you. Uh next uh next lady, please, name and address. [3:51:00, 3:51:00]: Yeah. [3:51:05, 3:51:17]: My name is Nancy Payne Coughlin. I have lived in Stock oh three oh three Oak Hill Terrace, Stockbridge. I've lived in Stockbridge thirty nine years, thirty-one at the home I'm in now. [3:51:19, 3:51:28]: I'm gonna not even go into the not in my backyard, even though it literally will be in my backyard. First, thank y'all. [3:51:28, 3:51:37]: And I wanna thank Mr. Brock. I called him. He answered my call on a Friday afternoon at three thirty, which most people don't do. Thank you. [3:51:40, 3:51:47]: My biggest concern is the commercial aspect. I used to own commercial property. [3:51:47, 3:51:51]: If you have C one or C two commercial property, it is a gift. [3:51:52, 3:52:12]: North Henry Boulevard, those four lots that you're talking about. The funeral home will have to go. But you've got four commercial, I think they're C one lots. You talk about, we want people to come to the concerts, we want to have little coffee shops, we want to have bookstores. [3:52:12, 3:52:30]: We want to have these four lots. We don't have a city square. We don't have a quote unquote downtown. From Flippin Road to East Atlanta Road is basically what people consider our downtown. [3:52:30, 3:52:32]: Let it be commercial. [3:52:32, 3:52:37]: And be nice commercial places where we can go. That's [3:52:38, 3:52:58]: I'm sorry. But I mean I understand that's the only way they can get to the ten acres in the back, but at some point there's gotta be some kind of compromise. I don't know what the solution is, but there's gotta be a solution and you gotta listen to all these people because it will definitely affect like I say it's gonna [3:52:58, 3:52:59]: [13980.0, 14000.0]: in my backyard, no more filling up my bird feeder in my nightgown every morning. So please, please. And I do want to thank Mr. Thomas. He's lived here and been involved probably as long as I have. So he's been around a long time. Thank you. Thank y'all. No, thank you, ma'am. [3:53:20, 3:53:22]: Next individual please name and address. [3:53:26, 3:53:30]: Elizabeth Hargrove, one oh three Club Place, Stockbridge, Georgia. [3:53:31, 3:53:35]: And I just the the project um [3:53:35, 3:53:50]: It's it's ninety units, it's too big for that area and the Okay, hold one second please. Okay, council, that's ten minutes. Wanna extend the time for these folks here? Okay, got it. Okay. We'll extend the time, ma'am. Go away, please. [3:53:50, 3:53:52]: Reset the clock, please. Uh Madam Clerk. [3:53:54, 3:53:54]: Coin. [3:53:55, 3:53:56]: And um [3:53:57, 3:54:05]: Okay, so it's too many units. It's it's gonna be a glut of traffic. And uh to this lady's point, yes, it's it's not [3:54:05, 3:54:18]: consistent I know that y'all are trying to have a vision for what Stockbridge is, but I think there's a reality of what it is. Um we don't have McDonough Square and I've heard people talking about um [3:54:18, 3:54:25]: you know, Decatur or downtown Atlanta and and the these different facades of these townhomes. [3:54:26, 3:54:38]: Th this is these are really more traditional communities, I think, that stuff Stockbridge. So but yes, I think it's gonna be too many units. I'm concerned at Club Place where I am. [3:54:38, 3:54:50]: There's no um there is gonna be a twenty-five foot barrier, but there's gonna be no privacy fence and people will drift into the neighborhood. That's just the way it is, and whether it's children, [3:54:51, 3:54:57]: uh adults because we get foot traffic as it is and we see these people and we go, where where they've even come from? [3:54:58, 3:55:00]: Um so that is concerning [3:55:01, 3:55:03]: Um also the amount of water. [3:55:04, 3:55:07]: F the flooding from the creek that's back there. [3:55:08, 3:55:11]: Um а no the property where I am already. [3:55:12, 3:55:28]: uh it I don't even know how many yards you would say that is, but it does flood up to up the property and once there's a glut of water coming off of the proposed, it's only going to increase with the glut. It's only going to back up even more. [3:55:28, 3:55:29]: Um [3:55:30, 3:55:31]: And [3:55:33, 3:55:53]: And then I am concerned about that that access, that back access off of uh on Club Place. I I don't like that. It's disturbing. It's going to be a roadway. I know it's supposed to be locked, but there's going to be foot traffic from that. And and I thought Stockbridge has a no parking on the street ordinance already. [3:55:52, 3:55:55]: Ready and you know uh [3:55:55, 3:56:11]: Maybe I don't understand the law as to why that aspect of it is even needed, but um it seems to me that if they enforce the codes on no street parking, that if the emergency vehicles need to access the property off of Highway 42, they can do that. [3:56:11, 3:56:18]: And um that's the extent. Thank you very much. Thank you for your comments, sir. Please name and address. [3:56:20, 3:56:25]: Good afternoon. My name is Charles Freeman. I live at one hundred turning point. [3:56:26, 3:56:29]: I've been in this house for twenty six years almost. [3:56:30, 3:56:40]: And I really have loved this area. When I first moved here from Memphis, I moved here in ninety one. I lived in Riverdale. Didn't like it. [3:56:40, 3:56:42]: Just got lost a little bit. [3:56:42, 3:56:44]: And found this subdivision. [3:56:45, 3:56:49]: The thing about this you all you all have to put yourselves in our position. [3:56:50, 3:56:57]: Especially the people, not just only the people just that's moved there maybe five or ten years, but the people that's been dedicated to this area. [3:56:57, 3:57:01]: for the twenty, thirty, some єers. [3:57:01, 3:57:17]: My concern mostly is about the development really truly. If you're gonna say that this is a commercial development, then how about we just keep it like that? Because once you start changing that development, then your landscape, your development of the [3:57:18, 3:57:22]: The w the way the water flows and stuff. We already get a lot of water already. [3:57:22, 3:57:33]: What my house is at, it's a heel. So all that water comes there. And it it kinda floods up the area. And I have a drainage area in my yard, but it'll actually be about [3:57:33, 3:57:37]: good two feet over that drainage and I'm like, why the water's not going there? [3:57:38, 3:57:38]: So [3:57:39, 3:57:42]: But I think you guys just need to put yourself in our position. [3:57:43, 3:57:44]: Pretend that you live where we live at. [3:57:45, 3:57:52]: We don't want crime where we are. It's really nice there. You you if you didn't know any better, you could actually sleep with the door open that I wouldn't do, but [3:57:53, 3:58:01]: You know, y that's just old school stuff that doesn't exist today. So I'm just asking you all to plead with us. [3:58:01, 3:58:09]: Look at us and how we are living and it is not it's no crime and it it's a blessing for me. I feel very honored to live. [3:58:10, 3:58:22]: in this area. So you guys just take that in mind. You know, think about hard working people like yourselves and do the right thing. Have a good night. Appreciate it. Ma'am, name and address please. [3:58:27, 3:58:31]: Karen Charmain, one ten Creek Circle, Stockbridge. [3:58:32, 3:58:35]: Stockbridge North community backs up to [3:58:35, 3:58:38]: The club circle community. [3:58:38, 3:58:41]: We have a problem with Brush Creek. [3:58:41, 3:58:44]: We have had a problem with brush creek. [3:58:46, 3:58:53]: Council member Thomas, I'm sure, remembers all this that went on to the redevelopment of that. [3:58:54, 3:59:02]: I would invite you all to put your boots on and come walk with me along where my property backs up to the creek. [3:59:03, 3:59:05]: Where some of these other people live in [3:59:05, 3:59:10]: their community in the club circle or the club club circle. [3:59:11, 3:59:13]: Club drive area. [3:59:14, 3:59:14]: Now [3:59:15, 3:59:21]: When you want to talk about stormwater runoff, I have spent tens of thousands of dollars. [3:59:22, 3:59:31]: With French drains, gutter systems, underground gutter systems, spillways, dirt being hauled into my property. [3:59:32, 3:59:40]: Transit lines shot just because of the development of all the concrete up creek from me. [3:59:41, 3:59:50]: Again, Mr. Aaron at the public serv public works department, he probably knows me on a first name basis. I need to take the gentleman to lunch. [3:59:51, 3:59:55]: Now again, I welcome you to come and take a walk with me. [3:59:56, 4:00:00]: It is swamp city down there. It's like Zika City. [4:00:00, 4:00:10]: Snake Pit City, encroachment on wildlife, already an eyesore back there, uh a human health threat. [4:00:11, 4:00:13]: Биказ в догнат water. [4:00:14, 4:00:31]: If you start cutting through club place to have an access, access only for emergency vehicles, you may as well forget it. Because once that happens, I already have people walking up along my picket fence, cutting through the city right of way, right down here. [4:00:32, 4:00:36]: That I have to run off. I'm I'm gonna post some no trespassing signs. [4:00:38, 4:00:40]: I'm sorry. [4:00:40, 4:00:42]: Амна агіест. [4:00:43, 4:00:53]: bettering things. I'm for progress, but I'm also for preservation and tradition. I'm probably in one of those older houses [4:00:55, 4:00:59]: That was built a long time ago, nineteen eighty. [4:01:00, 4:01:04]: However, my house is not made out of matchsticks. [4:01:05, 4:01:10]: I have a good house. I love my neighborhood. I have a diverse neighborhood and come to think of it. [4:01:10, 4:01:17]: If anybody knows about DEI, diversity, equity, and inclusion, it is me. I was a special education teacher. [4:01:18, 4:01:24]: I probably know more than most people would know about that kind of thing than in their entire lifetime. [4:01:26, 4:01:28]: So my thing is [4:01:28, 4:01:45]: Don't put a cut through and call it an emergency cut through because it won't be there. We'll get traffic, we'll get undesirables, we'll get kids. There's kids I've had to run off that aren't even in my neighborhood from playing in the creek because I don't want a liability issue. [4:01:47, 4:01:53]: And when you consider these votes that you all are doing, just remember this. [4:01:53, 4:01:55]: You have your job here. [4:01:56, 4:01:58]: On this council? [4:01:58, 4:02:00]: Because you were elected. [4:02:01, 4:02:08]: You were elected to this position to represent all the citizens of Stockbridge. [4:02:09, 4:02:10]: Надже [4:02:11, 4:02:13]: Some or one [4:02:14, 4:02:16]: And not for your own self. [4:02:17, 4:02:23]: You were elected to this position to serve the desires and the needs of [4:02:24, 4:02:26]: Of the citizens of Stockbridge. [4:02:27, 4:02:33]: And just as a friendly reminder with all due respect to every one of you. [4:02:33, 4:02:37]: And thanking my fellow citizens that are here. [4:02:39, 4:02:41]: We put you in this job. [4:02:44, 4:02:47]: So that means and according to the city of Stockbridge. [4:02:48, 4:02:49]: Organizational chart. [4:02:50, 4:02:52]: You work for us. [4:02:52, 4:02:54]: Not the other way around. [4:02:55, 4:03:01]: Thank you. Thank you for your comments. Um mister M Ryan and Mr. Gardner, come back to the podium, please. [4:03:03, 4:03:04]: No, no, not you, ma'am, you're fine. [4:03:05, 4:03:23]: Th uh by the way, on that note too, the public hearing is closed, by the way. All right, so uh once again w on a previous uh uh public hearing we heard about water issues, a turning point. I mean, what what do you know about any type of in that particular area? What can we do, what we need to do, and what's going on with that? Can you can you explain that? [4:03:24, 4:03:27]: I I have to give it Mr. Deshus. [4:03:27, 4:03:36]: Obviously he has a little bit longer history than I do here, so I can't say that since I've been here the last two years I haven't heard anything, but that's not to say that they haven't been communicating with Mr Dashes. [4:03:36, 4:03:50]: Okay. I don't know if uh the question something came up about easement as well, about the easement dealing with this development and and turning point subdivision. Uh we are we breaking the easement or how things go into buffers and things of this nature? Are we doing all right with that? [4:03:51, 4:03:53]: No, not that I'm aware of, not with this project. [4:03:54, 4:04:14]: All right. Now I know that we do have a parking no parking street ordinance. Uh let's see here. Uh and I know that what I understood is that we've now agreed the uh developer agreed to have two cars for the uh for each one of those townhomes. So one cars are out, so two cars there. Uh we agreed to that. That'd be part of the uh [4:04:14, 4:04:14]: Well. [4:04:15, 4:04:18]: The agreement they came up with we we agreed to if that's the case. [4:04:18, 4:04:20]: And um [4:04:20, 4:04:23]: See, see, see something else I had on my mind here. [4:04:23, 4:04:43]: Uh oh yeah. I think uh the three hundred two three bedrooms and three roughly three hundred fifty dollars, uh three hundred and fifty thousand I'm sorry, probably for uh the the the townhomes. Is that was that what I heard earlier? Three hundred and fifty and that means that and it's a gated community. So otherwise if anything, I would think logically speaking it it'd increase the value [4:04:43, 4:05:03]: of of of of the area around it with when it's a gated community, 350, two car garages. So I think that'd be helpful for the overall community in this aspect. Just my simple synopsis of that. All right. On that note I'll be quiet. Any other uh comments or questions the council may have. Yes I do. Go ahead. I like to can you show me all of the um [4:05:03, 4:05:06]: access points into this proposed development, please. [4:05:12, 4:05:16]: There's one there, and then there's one right here. [4:05:18, 4:05:19]: True. [4:05:20, 4:05:24]: I ain't wondering more carrying emergency access. [4:05:25, 4:05:31]: So you need do you need to come up and help out or or is this? If you follow the cursor. [4:05:31, 4:05:35]: The the There's no connection beside the [4:05:36, 4:05:40]: So let's require pocket points real quick. [4:05:40, 4:05:51]: It's just two? It's one full access onto North North Henry and then this will be a gated emergency only access. And that's required by state fire fire code. [4:05:51, 4:05:54]: Okay. Are these for sale or rent? For sale. [4:05:55, 4:05:55]: Okay. [4:05:56, 4:06:02]: In the just with the is it five percent or ten percent? Ten percent cap on rental. Okay. [4:06:03, 4:06:03]: Um [4:06:04, 4:06:05]: Are you [4:06:05, 4:06:08]: amenable to decrease the density. I don't [4:06:09, 4:06:19]: I don't prefer to have that high density of ninety units and I definitely don't um prefer having you all develop the commercial piece. [4:06:19, 4:06:31]: I can't support this. But we are way below the existing density that surrounds us. Uh if you look at Oak Hill and Turning Point, we are below those densities and we're well below the medium density uh threshold. [4:06:32, 4:06:39]: So I mean we are not maxing out density at at any means. We're actually at the lower end of the density. [4:06:39, 4:06:42]: Okay, considering the um [4:06:43, 4:06:45]: The area around the [4:06:45, 4:06:50]: This proposed development is why I'm asking to decrease the density. [4:06:51, 4:06:58]: And and that's I guess what I was trying to allude to is that uh the density adjacent to us is actually higher than what we were proposing. [4:06:59, 4:07:00]: Um [4:07:00, 4:07:05]: The multifamily residential of the Oak Hill townhomes is [4:07:07, 4:07:07]: Um [4:07:08, 4:07:13]: Is six point six seven units per acre. Turning point is uh approximately [4:07:14, 4:07:15]: Can you show me that? [4:07:15, 4:07:18]: Okay is this development right here. [4:07:20, 4:07:22]: And how many own units are there? [4:07:22, 4:07:25]: There are approximately sixteen units. [4:07:25, 4:07:27]: And then turning point is at [4:07:28, 4:07:42]: There's only sixteen units in the Oak Hill townhome. That's correct. And then Turning Point, which is a urban single family detached product or product, uh, is at a density of eight point zero seven units per acre. [4:07:42, 4:07:48]: And how many units? Uh forty five are there? Forty five. Twenty five. Forty five. Forty five. Okay. [4:07:48, 4:07:49]: Again. [4:07:50, 4:07:51]: This is high. [4:07:52, 4:07:53]: Density. [4:07:54, 4:07:55]: Residential. [4:07:55, 4:07:58]: In my buck, with the amount of units. [4:07:59, 4:08:00]: That's what I'm looking at. [4:08:01, 4:08:03]: I don't support it. Sorry. [4:08:05, 4:08:17]: All right, any other questions, uh go ahead go away, Ms. Gantt. I isn't it possible I know you had mentioned the square footage being about fourteen hundred square feet to two thousand? That's the low yeah, that's the rank it [4:08:18, 4:08:27]: What's that? We're not oh yeah. We're not uh four star is not the end builder, so those uh uh floor plans fluctuate, but that's a general range fourteen hundred to two thousand. Uh [4:08:27, 4:08:30]: You know, average is around eighteen hundred. [4:08:30, 4:08:33]: It's around eighteen hundred units or square. [4:08:34, 4:08:54]: Um my concern is my preference I'm I'm a very concerned about a fourteen hundred square feet anything in the area. I don't know. Um especially we'll have you know, we're asking for two car or garages. We're so eighteen hundred to two thousand square feet or si between sixteen to two thousand square feet. I've almost fifteen. [4:08:54, 4:09:05]: I'm sorry? The minimum is fifteen hundred square feet. The minimum is fifteen hundred. And plus since we're going to the two car units, uh that for it'll likely be larger. [4:09:05, 4:09:06]: Okay. [4:09:08, 4:09:17]: But so are you not able to do sixteen hundred square feet to two thousand? Yes. Yeah. That's a sixteen minimum. Okay. [4:09:18, 4:09:30]: Again the minimum I'm sorry, go ahead. No, you you got it next. Go ahead. I was just gonna make a point of clarification. When you said [4:09:30, 4:09:43]: uh this po uh property or develop it is less dense than turning point and others. It is because not because of the quantity, but because of the land mass, correct. This property is is a very larger [4:09:43, 4:10:03]: piece of property. So the number of units per land makes it less dense. Well and the fact that we have almost thirty percent open space. Right. Um I mean if we wanted to develop up to the medium density residential seven point nine nine units per acre, we would be over two hundred units. And I'm I'm looking at your diagram, you still have how [4:10:03, 4:10:23]: How about how many acres is that from the pond down to the creek and be and to the edge of the property? It's approximately four point three acres. Of undeveloped space. And then on the which I guess that would be the west side of the property, but the bottom that we're looking at, you still have a large amount of landmass in that area. [4:10:23, 4:10:26]: [15026.4, 15044.7]: What type of buffer will you be using in there? W will there be a fence? I know someone s talked about fencing. Some of the people's concerns were will it be fence? And then um this access road becoming a pedestrian path. What type of material would be used for that fence? [4:10:45, 4:11:00]: For uh the access the gate. For the gate. Uh I mean we don't have that designed yet, but it will be a lockable gate, likely a metal gate. Um it something that will allow the fire department easy access to in in uh instances of emergency. [4:11:02, 4:11:22]: And whether be like shrubbery or like um canopy of trees between I guess the western Yeah. If you can see here there's a seven or twenty five foot zoning buffer. Um there's approximately a hundred feet between the back of our units and the property line here. There's almost four hundred feet between the the the back the the last [4:11:22, 4:11:33]: That's back wall of the property to the canopy. To our property line. So that's, you know, over a football field. [4:11:34, 4:11:41]: The over a football field. Yeah, between our the back of our units to the back of the house on club. So I mean it the buffer is significant. [4:11:43, 4:11:43]: Okay. [4:11:44, 4:11:45]: Thank you. [4:11:46, 4:11:57]: Yeah, go ahead, Mr. Wow, that that that's some new so bow, that's that buffer. And then basically what you're gonna do is leave that uh that wooded area undisturbed pretty much in those buffers. [4:11:57, 4:12:17]: For the that's correct. Within the twenty five foot buffer, um we will have to we haven't done our final grading, so I'm not sure where our limits servants would be, but we would have to grade behind the units. Right, right. But what I'm saying is you're not I mean, instead of just planting some new trees, you would d exercise the right if you could to just leave the existing vegetation there. [4:12:17, 4:12:37]: Instead of going out and buying some new trees. That's correct on that 25-foot buffer. Okay. All right. And uh what was the other question? Certainly. Okay, I'm done. Done. Mr. Barber, Mr. Mr. Berry was uh very insightful. All right. So on that note, if they're not [4:12:37, 4:12:42]: I do have a comment, Mayor Ford. [4:12:43, 4:12:47]: No one mentioned flock cameras. Is that one of the conditions added here? Yes. [4:12:49, 4:13:09]: We did. Is that a condition that was added? That's a request. And I'm sorry if we haven't mentioned it yet, but that's definitely a request. Everything that we normally do should be a request for standard from now on. And Ryan, if you don't mind making a middle note for adding that to our conditions in like you [4:13:09, 4:13:10]: You've done with the ten foot path. [4:13:11, 4:13:17]: It just so we're clear on what you're asking, the flaw cameras are the cameras that take pictures of the license plates of field lantern and exit. [4:13:17, 4:13:33]: So we're requiring those from for any new constructions in any subdivisions now. Um for the safety of everyone. We we're requiring that the developer place flock cameras at the entrances and exits of subdivisions. And we're agreeable to that. That's fine. [4:13:34, 4:13:49]: Oh sorry, sir. I said we're agreeable to that. Good deal. All right. I I still have my question. Um I believe this second entrance of Club Place in fact I believe there was a young lady who was [4:13:50, 4:13:51]: Behind you. [4:13:52, 4:13:54]: Mr. Anderson, I don't know if she's still here. [4:13:56, 4:13:59]: This club place where this entrance is, is that where you live? [4:14:00, 4:14:02]: Okay, thought so. Um [4:14:04, 4:14:13]: She has some concerns with that. If you would speak with her um in regards to that entranceway into her yard. [4:14:13, 4:14:33]: Yes, we c I can I can get her information. And I don't know what is appropriate, Mayor Ford, um, but I'd like to make an amendment to our comprehensive plan, I believe it is, um, to require developers to notify all homeowners, not just the property owners whose property are but their proposed developments. [4:14:33, 4:14:38]: because that's what's happening. They're only required to notify [4:14:38, 4:14:39]: Property owners. [4:14:40, 4:14:43]: Who's adjacent or uh but's theirs. [4:14:44, 4:14:47]: So everybody else around it is not notified. [4:14:47, 4:14:48]: I'm spending my time. [4:14:49, 4:14:52]: having to get out and go and talk with these homeowners. [4:14:53, 4:15:03]: Is it the comprehensive plan, Mr. Anderson, that needs to be amended in order to require that would be the UDC. The UDC. Yes. Okay. But [4:15:04, 4:15:11]: Okay. Well once the council takes the vote on this public hearing, then I'd like to make a motion for that. Thank you, sir. [4:15:12, 4:15:21]: Well okay. We'll deal with that when time comes. All right. Any other questions from the council here? Okay. Not okay. If we're clear, so let's let's let's go down this road then. [4:15:22, 4:15:28]: Comprehensive plan amendment case C P two zero two three dash zero nine located in council district four. [4:15:29, 4:15:41]: Consideration of a request of a comprehensive plan amendment to change the future land use designation of certain property on north side of North Henry Boulevard and west side of Center Street Street as listed below from [4:15:43, 4:16:03]: Low density mixed use and medium density uh residential to medium density residential to allow for construction of a townhome development. [4:17:56, 4:18:01]: Right, this is r right, this restaurant would be. Right. I just want to verify. The conditions are on the next one. [4:18:03, 4:18:03]: Okay. I would like to request that the staff read all of the conditions to make sure that we have them all in there. Sure. Including the ten foot path and the flock cameras. [4:21:10, 4:21:30]: Condition number one is based on the site plan. The applicant will submit a site plan similar to the one they submitted on 1201, but this one will contain all two car garages and a realignment of the parking. [4:22:44, 4:23:04]: Okay, and honestly the the range is from sixteen to the sixteen hundred to two thousand, but we need the average to be around eighteen hundred as was suggested. So let's make sure that's in there. We we're capturing that, okay. Okay. All right.'Cause we want the average to be uh we don't wanna just build all sixteen hundred. We wanna make sure the average is [4:23:03, 4:23:09]: Above eighteen hundred to maintain the values. Okay, hold on. I think these gentlemen [4:23:10, 4:23:22]: He wanna he wanna ex they wanna exceed two thousand. So again oh no there's not a m there's not a m there's a minimum of sixteen hundred and they need to aver you go i I want it we need to average at least eighteen hundred. [4:23:24, 4:23:36]: I mean minimum eighteen hundred you will average. You can go as low as sixteen hundred, but you need to average over eighteen hundred with the unit. So you don't build all sixteen hundred square foot units. [4:23:36, 4:23:37]: Yeah, you might take it. [4:23:38, 4:23:43]: Uh okay, make sure that uh is that a concern of yours, sir gentlemen? Is that you good with that? Yeah. [4:23:44, 4:23:46]: How can what what's the [4:23:49, 4:23:53]: Well what in builder is injured. [4:23:55, 4:24:10]: Yeah, but we' w these are conditions of approval. So just say minimum sixteen and max twenty four hundred or something like that. Why don't we not need'em that just uh You don't need'em they don't need a max just need a sixteen hundred minimum. Yeah. And the average needs to be above eighteen hundred square feet. [4:24:10, 4:24:16]: Our average has to be above eighty nine. Yes. Just the minimum sixteen. I mean it's easy to do. [4:24:18, 4:24:29]: Alright. We're good now? Yeah, thank you. All right. Uh y you don't do um have all those conditions? Yes, we got'em. I can't recall. Did you say all of the units were a two car? Yes. Thank you. [4:24:32, 4:24:35]: You have that how about you, Miss uh Holliday? Did you catch all that? [4:24:36, 4:24:42]: Okay, good deal. So move. Okay, okay, is there a second to the motion? [4:24:47, 4:24:50]: Oh you said saying again, uh Miss Weber? [4:24:51, 4:24:57]: Yes. Okay, opposed. So it's three one one. Motion passed. [4:24:57, 4:25:17]: Three one one. All right. [4:26:58, 4:27:01]: Yeah, these are all the same properties. We have to do various own c [4:27:02, 4:27:03]: Okay. [4:27:03, 4:27:04]: Okay, what's the question, sir? [4:27:05, 4:27:06]: If we have [4:27:07, 4:27:14]: Almost a hundred yards to the back of one set of property. Why do we need to reset the variance if we have so much space? [4:27:16, 4:27:19]: Uh this is from the the town lots from the request under request. [4:27:20, 4:27:21]: Flood playing on the property. [4:27:23, 4:27:27]: Some of the area some of s some of the areas not buildable, so flip playing. [4:27:28, 4:27:31]: So the entire hundred yards to the west of this motherfucker? [4:27:32, 4:27:46]: To the west. What it promises the floodplain. What what part of the thing is? Right. Yeah. Which but because it's uh it's narrow it's is related. [4:27:50, 4:27:55]: Yeah. [4:27:55, 4:28:15]: Yeah. We have over what do you say fifty feet to the west? How much of that is floodplain and unusable unusable land? What's what's the need or the requirement for pushing it back? A couple of needs. One to move the development more towards the center and away from the adjacent residential uh to accommodate above [4:28:15, 4:28:35]: For the adjacent residences. And there's also grading concerns. The site slopes downhill. It's a very narrow site. So we will need that room for grading. And also it reduces the amount of front yard. The HOA is providing maintenance of the landscaping. So a larger front yard increases the cost. [4:28:35, 4:28:37]: cost for the uh HOA fees. [4:28:40, 4:28:45]: Okay, Mr. Alzheimer, you made a motion, Ms. Ganttz second that motion. All favor of the motion, please indicate. [4:28:46, 4:28:50]: Okay. Oh you you're you're sustaining you which you [4:28:51, 4:28:56]: You voted four? Okay, four. Okay, Miss If you would just ask [4:28:57, 4:29:17]: Who opposed just like you asked who approved. I've got that. They could be this could be a large problem. I got I got three people for post. You oppose for three one one. Motion passed. There you go. All right. Thank you, sir. Thank you. Thank you. All right. Uh on that note, new business. Resolution accepted dedication of portions of the property at thirty nine eighty six. [4:29:17, 4:29:37]: Jodico Road near Candler Road to be used as a public park. Consideration of a resolution to accept portions of the property 3986 Jodico Road near Candler Road within the Stockbridge City limits to be dedicated to the city of Stockbridge by its owner. Candler Road Stockbridge ProPopropco L [4:29:37, 4:29:57]: LLC per the exec uh executed a dedicated agreement between the parties dated December thirteenth, twenty twenty three for use of the city of Stockbridge as a public park and for other public purposes, which is to be constructed by property owner according to the multi-agreeable development plan. Property comprises parcel. [4:29:57, 4:30:17]: Numbers zero seven excuse me zero seven one B zero three zero four six zero zero zero located land lot sixty three and sixty six of District Seven within Henry County, Georgia. And it contains two tracks uh with one point one four uh total acres, track one companion uh containing [4:30:17, 4:30:35]: uh point five nine three acres and track three containing one excuse me point eight one one acres as are depicted in exhibit a and exhibit b of the delegation agreement. Mr Anderson please. [4:30:35, 4:30:55]: Uh yes, this is um this item is for the um city to accept um the dog park as part of that was part of the agreement between um the warehouse group on 175 Kemler uh road. And here is the concept plan right here. In the middle you have the dog park. [4:30:55, 4:31:13]: Surrounding the dog park, you got sidewalks all the way around. And on the outskirts on Jodeco Road and beyond you got a ten foot multi platform trail that stops at around right here before you get the to um there's a big ditch with a lot of trees in it that [4:31:15, 4:31:35]: prevents the uh the ten foot um multi trail from going all the way around. So they the uh developer agreed to extend it further than his original development agreement with the city. So he's extending it to about right here. The original development agreement called for the multipurpose trail to stop right here where I got my cursor. But [4:31:35, 4:31:40]: H now the developer has agreed to extend it to um to the end of the [4:31:41, 4:31:49]: the um possible development the developable l developable land. There's some land, um there's trees in the [4:31:49, 4:32:05]: and a floodplain, uh well a creek that prevents the um the ten foot multi purpose trail from going any any further. So, but originally with the agreement that he originally signed with the city, he was supposed to stop right here, but he's extending it until he gets to that barrier right there. [4:32:07, 4:32:09]: So any um inside the um [4:32:10, 4:32:22]: The dog park will have like seven benches and a f and a fence and there's the entrance right there. So it just requires the city to accept and then it'll be part of our park system. [4:32:23, 4:32:33]: Mayor. Yes, sir. Okay, when I was out there, Mr. Gardner, you there? Do we get the agreement that the trail around the dog park was to be paved? [4:32:37, 4:32:41]: Come on. The the velpers here. Come on. Come up, boys. [4:32:42, 4:32:46]: There was only it was only like a gravel trail. That part it needed to be [4:32:48, 4:33:06]: Hi, uh Wes Simpson, ten fifty Crown Point Parkway, um, suite seven sixty Atlanta, Georgia. Um yes, right now it just has a gravel base due to weather. We're actually gonna do concrete in lieu of asphalt on that trail to blend in with all the other sidewalks around it. Okay. [4:33:07, 4:33:15]: Well, certainly appreciate that and uh extending the trail across the uh frontage as far as you could. So certainly. Thank you so much. Yes, sir. [4:33:16, 4:33:24]: Any other questions for the council? If not, I need a motion to accept this uh this resolution, accept this dedication of this property for us. [4:33:24, 4:33:31]: Thank you, so m uh so move, thank you. Is there a second? Uh m Mr. Berry, second that from Alexander. Mr Berry, all in favor, please indicate. [4:33:33, 4:33:53]: Okay, now decision. Thank you very much. Appreciate it. Thank y'all. No problem. You're welcome. Announces of upcoming meetings and events.
