Thing recognizes women throughout the country who understand that for a positive future we need to eliminate violence and discrimination entirely relies at institutions. And whereas women from every background have long realized that an uneven playing field will never [0:20:09, 0:20:29]: bring equality or justice. [0:36:09, 0:36:25]: The adoption of retreat meeting minutes from February sixth, adoption of retreat meeting minutes from February seventh and also February eighth, and our work session minutes from February twenty seventh. Uh if there are no changes to that, then I need a motion to accept those into our f record, please. [0:36:26, 0:36:31]: So move. Is there a second for Mr. Alexander? Is there a second? Mr. Berry, all in favor, please indicate. [0:36:32, 0:36:36]: Okay. Um Madam Clerk, do we have any public comments? [0:36:38, 0:36:58]: Thank you very much. Uh ladies and gentlemen for our ceremonial review. Uh this is uh Women's History Month and so uh we actually had a proclamation read earlier today. Demetra Daniels, uh the president of DST for the Henry County Chamber, was here to pres uh to receive that along with her fellow Saurar. So DST members, thank you for being here. Appreciate it, ladies. [0:36:58, 0:37:18]: We also swore in Paige Jones, the third, from the Stockbridge Citizens Police Advisory Committee and Crystal Park for the Main Street Advisory Board. And obviously, those individuals are more than welcome to stay for the meeting as long as they like. On that note, ladies and gentlemen, we have new business. We have the downtown pedestrian and bicycle connectivity study, adoption number. [0:37:18, 0:37:28]: another study which was prepared by Keck and Wood in a consultation with the city's uh community development staff. And this is going to be presented uh initially I got here Mr. Ryan Anderson, please. [0:37:28, 0:37:30]: Uh yes, sir. Good evening, Mayor. Um [0:37:31, 0:37:47]: On August the fourteenth, we came before um city council, the consultant and and staff, and we presented the downtown pedestrian and bicycle connectivity study. Um so right now I have the final draft and I'm asking city council to uh endorse and adopt the plan. [0:37:48, 0:37:58]: Well, okay. Could you actually go through this, make sure we're on record so I'm but go through the presentation and then uh I will ask for a vote on this approval. Okay, yes sir. Appreciate it. [0:38:31, 0:38:32]: Okay. [0:38:42, 0:39:02]: Basically, the study identified a$7 million project for the city of Stockbridge covering uh 3,800 square linear feet. Uh the proposed curved quarters served to connect um Stockbridge Downtown, City Hall, and Clark Community Park along Burke Street, Lovejoy, Love Street, Jim Clark. [0:39:02, 0:39:17]: The existing pedestrian facilities are in substandard condition, lack connectivity, and suffer from ADA noncompliance. Bicycle facilities do not exist in the area at this time. [0:39:19, 0:39:39]: The description of the proposed project. The project is completely located within Stockbridge and is thirty, like I said, 3,800 linear square feet in length. Improvements will be along Burke Street and will start at North Henry Boulevard, US 23, and continue north to Parkwood Drive. Improvement on Burke Street will include a concrete curb and gutter. [0:39:39, 0:39:59]: Asphalt shared use path along the west side. Concrete paver sidewalks along the east side, along with pedestrian lighting, street trees, and landscaping. Back in the angle parking is also back in the alley, back in back end parking is also proposed along the east side. [0:39:59, 0:40:19]: Of Burke Street. Improvements along Love Joy will start at Love Street and continue north to Burke Street. Improvements on Love Street include concrete curb and gutter, concrete sidewalks, pedestrian lighting, street trees, and parallel parking along the west side. Improvements along Love Street will start at Burke Street and continue east. [0:40:19, 0:40:39]: To East Atlanta Road. Improvements on Love Street will also include curb and gutter, concrete paver sidewalks along both sides, south side only east of Love Joy Street, pedestrian lighting and street trees, and an ADA-compliant Ed-Grade crossing at Norfolk Southern Railroad. [0:40:39, 0:40:52]: required gates and concrete grade crossing system with flagway flyers. A pedestrian bridge is also proposed, spanning MLK Heritage Trail and the two Norfolk Southern Railroad tracks. [0:40:54, 0:41:01]: And Ward Street. So that's that's a that's basically a summary of the project. Okay. And um I'll get to the cost summary. Okay, appreciate that. [0:41:06, 0:41:12]: This is the project map location right here. Okay. And then red it highlights all the areas that would be affected. [0:41:15, 0:41:18]: Uh this is the cost estimate of the pr uh of the project. [0:41:19, 0:41:30]: The total comes after a little over seven million dollars for the total cost. Um after Mayor and Councillor endorsed and approved the plan tonight, um we will seek [0:41:31, 0:41:42]: We will shop this project to try to get funding for it. Um from the ARC is a potential site, the G G DOT and other grant opportunities out there. So after we get approval, we'll start shopping this plan. [0:41:44, 0:41:48]: So the schedule is it's inside. Um [0:41:49, 0:41:54]: Also I have um binded copies for each of you. I'll pass it along to the clerk. [0:41:56, 0:41:58]: So if you have any questions already asked them. [0:41:58, 0:42:00]: Yes, I appreciate it. Okay. [0:42:00, 0:42:02]: Yes, sir. Yeah, go ahead, Mr. Alzheimer. [0:42:05, 0:42:14]: about uh the staff foundation's involvement and us communicating with them. We would have a meeting uh with Mr. Gamper, I believe, last week. [0:42:18, 0:42:20]: Basically you'll just be incorporated. [0:42:25, 0:42:35]: Yes, they will um working with Eric, we'll be going through all of our plans and uh all the recommendations to be incorporated as part of the overall part implementation plan that we're doing. [0:42:36, 0:42:44]: So yes, this document will be part of that discussion and and formulation of the the um implementation path plan for the path. [0:42:46, 0:42:55]: So I'm sorry. So everybody understands we received a grant, right, that actually funded the trail study from the ARC. Yes, sir, for a hundred thousand dollars. [0:42:56, 0:43:09]: Right, so this is part of we went out and we saw funding for uh the multi-use path network and then we were able to obtain some funding for that. Could you put the map back up for me, please? Which slide? Okay. [0:43:22, 0:43:42]: As we look at the map here, which is you know, we've had a couple of studies done, we've had this one done, we've had the trail plan done. Certainly we're working in unison with Henry County for the the um countywide trail network. But certainly this was isolated to uh the existing downtown area. As a member of the downtown [0:43:42, 0:44:02]: Development authority, we have often discussed, and as part of what we did was the TSW Master Parks Plan, they described a desire to connect uh city parks and uh city points of interest. So certainly the DDA had expressed previously that they wanted [0:44:02, 0:44:19]: To see as we have here the Love Street Trail as it exists down Lovejoy Street, if that could be connected, run across the tracks and connected to the amphitheater existing trails. [0:44:19, 0:44:39]: That would help us in some connect some additional connectivity. And basically we would be able to connect the two parks, the amphitheater park, and then the uh park at Clark at Clark Park as well. So that would be kind of like low-hanging fruit if we could uh adjust this. This is pretty much looks like they've got outlined what [0:44:39, 0:44:59]: Needs to be done, but that extension uh going across the tracks right there certainly would allow us to be able to connect the two parks. So if that's some cut further conversation we can have uh with Mr. Gantther and Pa to kind of uh bring all of that together. Um I think we're about to get ready to [0:44:59, 0:45:03]: finalize the the parks master plan here pretty soon too, right? [0:45:06, 0:45:26]: Okay, so all of these things are coming together and it seems like a puzzle that we've been working on for a while. But folks, so if you haven't been to downtown Stockbridge, and I'm talking to the audience now, you should come down because we have extensive trails already in downtown along East Atlanta Road, through the amphitheater, Bryant Street. Uh there's a bunch of new [0:45:25, 0:45:44]: trails so if someone's looking for a walking course they need walk no further than right side outside of city hall uh to be able to do so. Thank you. Ms. Gardner before you go sir uh it's my understanding that uh when we take a trip here to DC that this additional funding for this is on our agenda to discuss this with our our senators. [0:45:45, 0:45:47]: Uh it will be, yes sir. [0:45:47, 0:45:52]: I I think I this one wasn't f finalized on there, but I can actually add that to the list of the projects. [0:45:53, 0:46:13]: Alright, so thank you. Because a portion of it it's already um if you think about the pedestrian bridge. Right. So we got some appropriations for that already. Okay. So some of this is already in the works. Stand by for a second, please. Any any other um comments comments from the council. You good? Everybody's good? All right. So what what I in a sense what we need here [0:46:13, 0:46:24]: But is there um this other Kekinwood, are they gonna give a presentation tonight as well? No sir. They've already they presented to you on August the fourteenth. They presented the final draft of this study. So I'm just bringing it here tonight to get it adopted. [0:46:25, 0:46:27]: All right. So I I need a motion to accept this, please. [0:46:29, 0:46:46]: I'll make a motion to approve what has been described by the staff, uh continuing the progress and with discussions with uh the PAF Foundation to make our trail network come to realization. Sir seconded the motion. Mr. Barrett, second that motion. All in favor, please indicate. [0:46:46, 0:46:49]: Thank you, sir. Thank you, Mr. Ryan. [0:46:50, 0:46:50]: So there you go. [0:46:51, 0:47:11]: Council consideration approved the emergency change order of a maze crossing lift station and force main rehabilitation project with all South Construction Incorporated amount of fifty-six thousand eight hundred and thirty-three dollars and seventy-eight cents. Funding sources from SPLOSS. Mr. Aaron, please. Yes, Mr. Mayor and Council. The city currently has uh [0:47:11, 0:47:31]: uh lift station rehab project ongoing at the maze crossing lift station. And while we were performing this project, we noticed that there was an issue with the sewer line. I put a copy of a picture of of the sewer main on your desk. And uh we're just asking while we have the contractor out there, if we can go ahead [0:47:31, 0:47:44]: and repair this section of sewer main before it collapses and then we have issues with sewage entering waters of the state. So while we got the contractor out, we thought it would be more expedient to go ahead and get this repaired. [0:47:45, 0:47:47]: Okay. Any questions for Mr. Aaron? [0:47:48, 0:48:05]: Uh y what's the funding source for the public to understand where the money's coming from? The funding s source is SPLOSS. The city allocated resources in its in SPLOS five for water, sewer, and stormwater improvements. And so this would come out of the sewer portion of the SPLOS five funds. [0:48:07, 0:48:08]: Any other questions? [0:48:08, 0:48:17]: Is is it only just this, where is that about what, ten feet over the ravine? Is is there anything that needs to be done? [0:48:19, 0:48:23]: So what's actually is gonna happen is in the middle of that [0:48:23, 0:48:36]: They're gonna set a manhole and then they're gonna fill that in with dirt so that the two l sewer mains connect to a manhole. So in the event something happens in the future, it washes out, it'll still just discharge into that manhole. [0:48:37, 0:48:39]: And uh provide more stability. [0:48:41, 0:48:42]: Nose. [0:48:44, 0:48:45]: Any other questions, Council? [0:48:47, 0:48:49]: If not, I need a motion to approve this, please. [0:48:50, 0:48:53]: So moved. Okay, Ms. Barber, second. Is there a second? [0:48:53, 0:49:04]: Mr Mr. Berry's second all favor, please indicate. He's nanous decision. Uh Mr. Aaron, could you take off that somehow get rid of that presentation, this old presentation? You can kind of just get rid of that. [0:49:18, 0:49:20]: Thanks, sir. All right. [0:49:23, 0:49:43]: I think Council Consideration approved their mercy back up, excuse me. Council Consideration approved and s the a sign and request requested intergovernmental agreement with Henry County Board of Commissioners, indicating a city, a Stockbridge commitment to share a local match for resurfacing of Eagles Line Parkway, Hudson Bridge Road, East Lake Parkway. [0:49:43, 0:49:50]: an amount of um eight million, eight hundred excuse me, eight hundred thousand, excuse me. Jeez. [0:49:50, 0:49:53]: Funny source is T Splas, presented by Miss Aaron, please. [0:49:54, 0:49:56]: Yes, Mr. Mayor. Uh [0:49:57, 0:50:17]: Every month, Henry County, G Dot, and all of the municipalities in uh Henry County have a monthly transportation meeting. And one of the things that came out of that meeting is Henry County's applying for a TIP a tip grant with ARC to assist with the resurfacing of Eagles Land and Parkway, Hudson Bridge. [0:50:17, 0:50:37]: Road and East Lake. As you're aware, we do have a joint T S Bloss project with the county for Hudson Bridge and Eagles Landing Parkway, but also East Lake Parkway, a portion of that is in the city as well, but that wasn't in the original T Splos. So this is an opportunity to try to leverage some federal funds. [0:50:37, 0:50:37]: [3038.1, 3058.1]: do a project that that is greatly needed that would benefit both the city and county. You know, these roads are major thoroughfares and I think it behooves us to to go in with them because East Lake was probably done about the same time as Eagles Land and Hudson Bridge. And it I think it'll be a seamless project if you do it all at once. [0:50:58, 0:51:14]: Instead of we do Hudson Bridge and Eagles Land and Parkway and we decide not to participate in the county, resurface the portion of East Lake that's outside of the city limits and you have that gap there. So I just think it's an opportunity to collaborate and get a a great project. [0:51:15, 0:51:35]: Thank you, sir. Questions, concerns? Ms. Barber. Ms. Barber, please. Mr. Aaron, whose recommendation was it to include East Lake Parkway? Yours? That was the county. So the the County is is taking a lead on this project to secure the grant, to apply for the grant, and they want us to participate. [0:51:35, 0:51:38]: with them. [0:51:39, 0:51:42]: uh project designed to include East Lake as well. [0:51:42, 0:51:50]: Okay. Just um one more question. So during our retreat in February, I know we talked about the T Sploss list. [0:51:51, 0:51:55]: This project wasn't on the T splash list, although I support it. [0:51:55, 0:51:57]: А вони нот проєкте. [0:51:57, 0:51:59]: Are we having to [0:51:59, 0:52:02]: kind of put off in order to accomplish this. [0:52:03, 0:52:23]: We're not putting off any project. The T splotch, it was just Eagles Landing Parkway and the Hudson Bridge. That's in the T splotch. This was added so that you have a seamless project. So you don't just do this part because really Easy Lake is a continuation of uh Eagles Landing Parkway just after it crosses. [0:52:22, 0:52:25]: Highway forty two, it just gets renamed. [0:52:25, 0:52:32]: Okay. I just wanted to make sure that we didn't put off something that we approved during the retreat. Thank you, sir. Mr. Thomas? [0:52:32, 0:52:34]: Thank you, Mayor. Mr. Aaron. [0:52:35, 0:52:55]: Uh we talked earlier today and that was one of my concerns. Um what project would be lacking in funding because of this and you indicated as you just answered, uh no none of the existing project will suffer from that. But my other question is [0:52:55, 0:52:59]: Um in the documentation it mentioned [0:52:59, 0:53:04]: uh general funds. I'm just a little concerned that maybe um [0:53:04, 0:53:24]: Mr. Gardner may be able to to uh answer that. I can answer that. Okay. That that verbiage is from Henry County. Henry County is using their general funds for this project. Okay. And that's what they're committing. So what you see in the agenda packet is the language that was transmitted to us from Henry County. [0:53:24, 0:53:25]: County. [0:53:25, 0:53:45]: So this is not the city's language or document. This is a Henry County document. So um the matching obligation from the city would come from um A combination of T SPLOS and SPLOS, because we have SPLOSS funds for road paving and resurfacing as well. [0:53:45, 0:54:05]: Well, in splots five. So this project, like I said, Henry County has a cost estimate of$10 million for this project. And so ARC would require 20% match, which is$2 million. And they said the city, 40% of these roads are in the city. So 40% of that 20%. [0:54:05, 0:54:21]: twenty percent match for the city would be eight hundred thousand dollars. And we've committed four hundred and twenty-nine thousand, I think, in T-SPLOST for the resurfacing of Hudson Bridge and Road and Eagles Landing Parkway. And so I just think it makes [0:54:21, 0:54:27]: I it would be prudent of us to go ahead and do eat'cause East Lake is gonna need resurfacing. [0:54:28, 0:54:34]: And while they're out there doing that, I just think that's the best time to go ahead and do the complete project. [0:54:35, 0:54:45]: Thank you. Well, um I know Miss Barber uh asked the question. I asked of this of you earlier. Would you just reiterate again, make it very clear [0:54:45, 0:54:49]: That none of the existing projects [0:54:49, 0:54:54]: would suffer from disallocation? No, sir. No sir. Okay. [0:54:55, 0:55:03]: We will continue to do the projects that we've outlined in T Splos and we'll spend the money that has been allocated for those projects on those projects. [0:55:04, 0:55:24]: Thank you. May I yield back. Thank you. Ms. Alexander. Uh certainly I appreciate that. And uh yes, we did when the T-SPLOST originally passed, it had Eagles Landing Parkway on there and Hudson Bridge. And the city had uh$400,000, I believe, uh in the T-SPLOST for that particular project. [0:55:24, 0:55:44]: And the county had like four million, but as we know, costs have ballooned tremendously. So the project, the$4 million that was put in T-SPLOST would not be enough in order to pay because Eagles Landing Parkway is six lanes in some places. Certainly again, we just recall. [0:55:44, 0:56:04]: that East Lake wasn't even included, correct? At all. So that would cost us maybe a million, million, maybe million to the uh uh maybe a million dollars to pave that section there uh roughly if we went out on our own. But this is excuse me, this is a great thing to me. [0:56:03, 0:56:23]: Because what it is is the county has recognized that the city cannot go it alone on these major corridors. They recognize that. Because if the the with the budget and where our budget is versus where theirs is, so they've indicated now that they're leaning forward to go out to seek additional. [0:56:23, 0:56:43]: funding even if the roadways are uh partially in the city limits because it benefits all of us. We know that the hospital for all of Henry County and South Metro Atlanta is in Stockbridge. And honestly it is an abomination in some areas, like right in front of the hospital. [0:56:43, 0:57:03]: Where it is a minefield of potholes that currently exist in that area. So I would hope that this same strategy would be taking place when it comes to Flippin' Road, when it comes to Valley Hill Road, when it comes to East Atlanta, Flippin' Road, and all of these major thoroughfares. This might be the pilot. [0:57:03, 0:57:23]: For the rest of those road projects as they come along. Because us as a city, we can't pave all of the all of the flipping road that's in the city limits now through the annexation or widen these roads as we would like to do without their cooperation. So this could be the model. [0:57:23, 0:57:43]: For how that would work going forward if we were able to make this happen. And to put 800,000 up for a ten million dollar project sounds like a no-brainer to me that we should certainly lean forward and indicate to them we want to make sure that this this is not just a singular partnership but [0:57:43, 0:58:01]: is a continuum partnership that goes forward. Because I I thought at that time, again, as we went along and the T-SPLOST was originally passed in 2021, well,$4 million to get it all done. But little did we know what would happen to these costs as we see, correct? [0:58:03, 0:58:04]: Mr. Bear, please. [0:58:05, 0:58:25]: Yes, Mr. Aaron. I just again wanna echo the words of wanna thank God for the collaboration between the county and the city on this project. Um it certainly uh affects all of us, as um Councilman Alexander has just stated. I did have a clarifying question. I know you said that this would uh be eight hundred [0:58:25, 0:58:30]: hundred thousand but we previously committed four hundred and twenty five thousand earlier [0:58:30, 0:58:48]: Will this be a total new eight hundred thousand or will it be a balance of three seventy five from what our previous commitment was? Our previous commitment was four hundred and eighty-nine thousand nine hundred and eighty-two dollars. So we'd have to come up with an additional three hundred and ten thousand eighteen dollars. That's yeah, that's what I wanted to clarify. [0:58:48, 0:58:49]: And that's blocks then. [0:58:50, 0:58:50]: Yes. [0:58:52, 0:58:53]: Any other questions from the council? [0:58:54, 0:58:57]: If not in the motion to approve, go forward with this. Mayor Ford. Yes, ma'am. [0:58:58, 0:58:59]: So then I have [0:59:00, 0:59:03]: Another question, I'm sorry. Don't go write it please. Um [0:59:03, 0:59:08]: So you said the balance would be coming from splot five? Yes, ma'am. [0:59:09, 0:59:17]: We have funding allocated in Splasby for road resurfacing and sidewalks, so we can use that funding. [0:59:18, 0:59:19]: To make up the difference. [0:59:20, 0:59:24]: Okay, so I'm looking at the list that we discussed during the retreat. [0:59:24, 0:59:26]: And I don't see [0:59:26, 0:59:29]: Um any funds allocated for [0:59:29, 0:59:35]: rows using s well, I'll take that back. There is one line. It's the twenty twenty four [0:59:35, 0:59:40]: ElMIG and the twenty twenty three sidewalk replacement project. [0:59:40, 0:59:42]: That's what we discussed during the retreat. [0:59:43, 0:59:45]: So I'm trying to figure out where [0:59:46, 0:59:47]: The phones are coming from. [0:59:47, 0:59:52]: Mr. Gardner. [0:59:53, 0:59:53]: Yes. [1:00:05, 1:00:06]: Right. [1:00:28, 1:00:29]: Yeah, so they're gonna speak. [1:00:37, 1:00:49]: Okay. All right. Mr. Aaron, so the um this report that you we discussed during the retreat, the line item it says twenty twenty four LMIG. [1:00:50, 1:00:53]: But it also says twenty twenty three sidewalk replacement. [1:00:55, 1:01:15]: But under the description, it says roads, bridges, sidewalks, and transportation. It just doesn't identify which roads, bridges, sidewalks, and transportation. We d we didn't identify it in the SPLOS because if something comes up, you want to move money somewhere else, you're not committed to a specific project. And SPLOS, it just put it in that category. [1:01:15, 1:01:17]: Or so you can use the funds. [1:01:17, 1:01:30]: Thank you, sir. You are. Any other questions from the council? If not in motion to accept this proposal. So moved. Mr. Alzheimer's, who's the second? Mr. Berry second. All favor, please indicate. She now she decisions. Thank you, sir. Thank you very much. Appreciate it. Mr. Aaron? [1:01:35, 1:01:36]: Okay. [1:01:36, 1:01:38]: It would address number [1:01:39, 1:01:45]: Well what we appr we approved that four roll? C Nam's decision was what's the issue? No, you skipped that you s you overlooked that one. [1:01:46, 1:01:46]: Overlooked. [1:01:47, 1:01:50]: Number four. The state state zoning procedures law? Yes, sir. Uh really? [1:01:51, 1:01:55]: My eyesight's big, where are my glasses? Where are my glasses? [1:01:55, 1:02:15]: I'm so sorry. All righty. That's a glass lack of glass and gray hair. All right. State zoning procedures law, adoption of recent changes to state zoning procedures law, incorporation of those changes to city of Stockbridge Unified Development Code. The Planning Commission approved the adoption of the changes in in this December 21st, 2023 meeting. [1:02:15, 1:02:35]: Mr. Aaron, please. And thank you, Cassandra. This is me. On November 13th, we came before City Council, the community development staff, and our consultant from CPA, Rebecca Kiefer, to present the mandated changes to our zoning ordinances that was handed down by the [1:02:35, 1:02:55]: the state. Uh we presented the draft form then and um we had a city council wanted a had a few recommendations so Miss Keefe went back and made some additional changes and updates and she's here to to present the final version tonight and to also um we asked for adoption of the changes. [1:02:55, 1:02:56]: Okay. [1:03:00, 1:03:07]: I'm so sorry about that. Staff kissed me straight. No one's as excited about zoning as I am and I I I understand that. [1:03:11, 1:03:17]: Right. Thank you for having me here again tonight to uh discuss the the changes. [1:03:17, 1:03:27]: Um, I think i in November I guess it was we had discussed kind of the the impetus for these changes and it was handed down by the state uh [1:03:27, 1:03:31]: with a requirement to add these various procedures. [1:03:31, 1:03:47]: Um the state does not uh usually get in the the business of how to zone, uh just uh determines is various procedures and notice requirements that you have to do uh to be able to to zone at the local level. [1:03:48, 1:04:00]: So there are a couple of bills that have happened over the last couple of legislative sessions to uh necessitate this change, uh, two of them being House Bill fourteen oh five and nine sixteen. [1:04:00, 1:04:20]: Uh these are amending uh 1405 amends the state zoning procedures law. And really it had several uh main uh objectives. It it desired to define quasi-judicial decisions, so those are things like variances and special exceptions, and uh previous to this uh [1:04:20, 1:04:34]: uh House bill there was no requirement at the state level for uh notice and procedure requirements. So it's just setting those similar to what you already had and and what you'd already experienced for zoning decisions like rezoning. [1:04:34, 1:04:36]: Um it also [1:04:36, 1:04:41]: kind of altered the appeal procedures that had been kind of muddied through through the years. [1:04:41, 1:04:46]: and um added some additional um house bill nine sixteen [1:04:46, 1:04:50]: Clarified a rid of seartiori uh appeal procedure. [1:04:50, 1:04:52]: That had um long been [1:04:52, 1:04:53]: Um [1:04:53, 1:05:13]: kind of outstanding as a difficult and and hard to follow procedure. So it it kind of cleaned that up a in some regards. And so then the House Bill fourteen oh five also set forth uh different appeals procedures, whether or not you're appealing a quasi judicial decision or a zoning decision. [1:05:15, 1:05:35]: So Senate Bill 213 uh also amended um this most recent legislation session, not the one we're currently in, uh amended the zoning procedures law to require that uh local and county governments allow um and not prevent [1:05:35, 1:05:45]: manufactured homes uh from being replaced, even if they are nonconforming um and and uh provided they meet uh they don't [1:05:45, 1:05:50]: uh meet these various of exemptions. So it's gotta be replaced or sorry, they do meet these various exemptions. [1:05:51, 1:05:56]: Um it's gotta be replaced with a new home. Uh it can't be a safety concern. [1:05:56, 1:06:03]: It can't have been discontinued for a period of twelve months, um and and various other uh [1:06:03, 1:06:09]: identifications in in the more detailed acts. So we also went through and made those changes as well. [1:06:09, 1:06:15]: So uh what I've done here is enumerate the changes that you see in your redline text draft. [1:06:15, 1:06:22]: Um we changed references of conditional use to special use. This is because [1:06:22, 1:06:28]: In House Bill fourteen oh five it actually defines special uses as um [1:06:28, 1:06:45]: zoning decisions and conditional uses as quasi-judicial decisions. And so we just wanted to make it clear that the special use permit process that you all have is a zoning decision. It is something discretionary and not a quasi-judicial decision. Uh so we changed that nomenclature throughout. [1:06:46, 1:06:53]: Um to be because these definitions got a little bit wonky and confused at the state level, um to [1:06:54, 1:06:55]: Mitigate your risk. [1:06:55, 1:06:56]: Um [1:06:56, 1:07:05]: Of whether or not people would appeal and say, no, no, no, you process this as a quasi-judicial decision, it's a zoning decision, or vice versa. [1:07:05, 1:07:08]: w uh we recommended and provided in the red lines [1:07:09, 1:07:20]: so that uh everything would be treated so that they meet and kinda check the notice and hearing procedures for both processes. So even if somebody wanted to argue that it was the other thing. [1:07:20, 1:07:22]: That's okay, you meet that too. [1:07:22, 1:07:31]: Um what that also does is gives you one calendar instead of a calendar for quasi judicial and a calendar for zoning decisions because that could get really um cumbersome to manage. [1:07:32, 1:07:52]: Um we also put in an exemption that is allowed at state law for city initiated uh zonings. Uh and this is a requirement that you are not required to post signs in the case of uh if you for some reason wanted to do a wholesale zoning. It does still require um the appropriate notifications. [1:07:52, 1:08:05]: that you've got in there. This is just to uh affect policy at a larger scale that is allowed at the state level. So it's just enabled. There's there's no changes uh recommended to zoning districts at this time. [1:08:06, 1:08:06]: Um [1:08:06, 1:08:08]: We adopted those additional or we [1:08:08, 1:08:12]: Did the text amendments to adopt those additional hearing procedures? [1:08:13, 1:08:33]: And um converted planning commission meetings to public meetings as opposed to public hearings, and that's just so that um the procedures of those meetings will continue as is. It's just so that that clock for the 30 to 45 day window that's required at the state level, it it's clear that that clock does not start ticking at at the point of the planning commission meeting. [1:08:34, 1:08:40]: Um we rep reference the appeals procedures that are required by state law based on what kind of decision it is. [1:08:40, 1:08:43]: And we clearly define multifamily uses. [1:08:43, 1:08:48]: Because there were some uh additions in the zoning procedures law. [1:08:48, 1:09:06]: uh that said if you're gonna put single family or if you're gonna put multifamily allow it as a use in a single family district that you've gotta do a a whole significant amount of hearing and meeting procedures. It's not likely something that you are going to do. But we wanted to make sure um [1:09:07, 1:09:13]: uses that are clearly single family are defined at the local level as single family versus multifamily. [1:09:14, 1:09:34]: Also, uh kind of opening up the draft and just wanting to make sure to um clean some things up, I think some of these are recommendations from our conversation in November. Um the Relupa Relevisions, that's the Religious Land Use and Institutionalized Persons Act. And what that says is it's it's a federal statute that says [1:09:34, 1:09:35]: You cannot treat [1:09:36, 1:09:37]: Uh places of worship [1:09:38, 1:09:42]: А лес фарабли than any other places of assembly, so movie theaters. [1:09:43, 1:09:52]: Um, you know, Masonic lodges, anything that is a place of assembly cannot be less restrictive. So you can't in a commercial district allow [1:09:52, 1:10:03]: a movie theater by right, but require a special use permit for a place of worship. So we went through and just made sure to right set those those uses so that you're on the right side of the Rule Looper requirements. [1:10:03, 1:10:04]: Um [1:10:05, 1:10:11]: We uh just kind of cleaned up some of the the re revocation procedures'cause that's something that's already in your authority to do. [1:10:12, 1:10:32]: Uh this was a big one from our previous meeting, the community zoning information meetings. And so we've crafted those in the red lines as an applicant-driven conversation with community, either virtual or in person, and they've just got to submit minutes and and sign in sheets prior to the planning commission meeting for those. So hopefully that starts that [1:10:32, 1:10:36]: out those conversations sooner than the more formal planning commission meeting. [1:10:36, 1:10:40]: And then we added the waiver process and also uh [1:10:41, 1:10:42]: Kind of sh [1:10:43, 1:10:50]: Switched your uh zoning uh list instead of a list of acceptable. [1:10:50, 1:11:10]: zoning uh variances, uh we switched it to a list of prohibited variances. And so that provided they uh are able to demonstrate a hardship, that just opens up the ability for people to actually come in and apply when there's a true hardship a regulatory taking, you do have that relief valve that's a little bit more permitted. [1:11:11, 1:11:26]: Um so with that, in December we took the red lines to the Planning Commission and they unanimously uh adopted those or recommended adoption of those and then it's here before you tonight um for adop final adoption. [1:11:27, 1:11:30]: I thank you for that. Appreciate it. Thank you. Council, any questions at all? Therefore. Yes, sir. [1:11:31, 1:11:32]: Couple questions. Oh, right ahead, please. [1:11:32, 1:11:52]: Uh I need to address this to Mr. Anderson, but you you can weigh in as well. Um the effect that it will have on our current UDC, uh would there have to be amendments and would we have to uh re-ratify? Uh no, sir. It won't it won't have any um amendments. [1:11:52, 1:12:06]: a major effect on the current UDC. We just have to implement those those changes because they're a part of state law and uh they are mandated for us to do. So we have we figured out a way to make it work within our within the framework of of our existing UDC. [1:12:07, 1:12:14]: Okay, so additions, but that would not be a need to come back before the council. [1:12:15, 1:12:19]: No sir. Okay. If it if you adopt it tonight, we good. Okay. [1:12:20, 1:12:23]: Thank you. Any other questions? M Ms. Barber, go ahead, please. [1:12:23, 1:12:26]: Mr Anderson, before you leave, I'm sorry. Yes, ma'am. [1:12:27, 1:12:30]: Um was it our last meeting? The meeting before. [1:12:30, 1:12:35]: I asked about updates to the UDC to require [1:12:35, 1:12:36]: Um those new [1:12:37, 1:12:40]: proposals that come forward to notify [1:12:40, 1:12:43]: All homeowners who live within. [1:12:43, 1:12:46]: I don't know, a certain distance from the proposal. [1:12:47, 1:12:59]: Does that include is it included in this update here? Uh no ma'am, we're working on that now. Our our attorney, Valerie Ross, is working on is researching and working on that. Uh that came after the fact. So we're we're in the process of working on that now for you. [1:13:00, 1:13:04]: Do you know when you will bring that before us? Um [1:13:05, 1:13:13]: Mayor. April. Um probably um to be honest, May.'Cause it would have to go to the Planning Commission in in uh April. So we'll bring it to you in May. [1:13:14, 1:13:15]: Thank you, sir. You're welcome. [1:13:16, 1:13:36]: Mr. Center. Yeah, let's let's be clear here, okay? We have to have some ratification of the council of that. You just can't say you do it and then we move forward with it. No no, sir. It would have to go through the public hearing process. It would have to be advertised at Planning Commission. But what I'm saying is that these individual items that are recommended to go [1:13:36, 1:13:42]: to the Planning Commission. I can't simply suggest it. This council has to suggest it as a whole. [1:13:43, 1:14:02]: You you're you're correct, sir, but um we were just looking at it um from a pro from a proposal standpoint. We was just gonna draft it up and take it to the planning commission. But um our lawyers, the zoning attorney is is researching it. The request was sent to her, so she's researching it. [1:14:02, 1:14:22]: Well, certainly we want to make sure that we do what's necessary to inform homeowners, but at the same time, we don't want to be in a position where it's cumbersome and comes to the point where it puts us in a competitive disadvantage to other cities because we want it the process to be friendly, because we want people to bring us quality projects. [1:14:22, 1:14:38]: The same type of projects that they bring us that you see on the north side where they're substantially they're quality built homes, and you don't want them in a situation where, you know, we we've already requiring them to have an additional community meeting, right? [1:14:39, 1:14:59]: Um yes sir. They but they were already um required to do a a community meeting with the residents. Now we're just formalizing the process. Right. Now it right. It was we were making with basically now they that's mandated, correct? Yes, sir. So the community meeting basically uh they'll have to have that now. They're every jury some jurisdictions [1:14:59, 1:15:19]: That that certainly is a good thing that they're doing that. I just don't want to keep adding regulations on it, which potentially slow down the process and put us in a competitive disadvantage because we desperately need quality housing in the city right now. Because of right now, if I wanted to go up new go buy a new construction,$400,000. [1:15:18, 1:15:38]: I uh I couldn't buy it here in the city because that doesn't exist. There's no new construction right now. We have been in a position where we haven't had that. We finally have builders coming to us because we've had an exodus of people from the city looking to upgrade because we don't have any upgraded material. So [1:15:38, 1:15:40]: When people come to us. [1:15:40, 1:15:42]: Трайна бринге кваліти проєкт. [1:15:43, 1:16:03]: Where they can actually stay in the city versus moving over to Hampton or moving down to McDonough, we certainly want to be able to do that. So I want to be very careful what we do with uh without making the regulation overly burdensome. Yes, sir. And whatever we do, we have to vote on it up here as a group to say this is [1:16:03, 1:16:05]: [4565.7, 4567.8]: That's correct. Thank you. Ms. Barbery. [1:16:09, 1:16:11]: Yes, Mayor Ford, I'd like to make a motion, please. [1:16:12, 1:16:13]: Go ahead. [1:16:13, 1:16:14]: Um [1:16:15, 1:16:17]: A move that we adopt. [1:16:17, 1:16:19]: The updates. [1:16:19, 1:16:21]: Um to the state zoning procedures law. [1:16:22, 1:16:23]: In addition. [1:16:24, 1:16:25]: I like to also task staff. [1:16:26, 1:16:27]: Whereas [1:16:27, 1:16:29]: Drafting a text amendment. [1:16:29, 1:16:33]: That requires homeowners who live within a certain distance [1:16:35, 1:16:37]: be notified of proposals. [1:16:40, 1:16:42]: Sir what is the what is the certain distance? [1:16:44, 1:16:49]: That is the research that the attorney he just mentioned is doing. [1:16:49, 1:16:51]: But I'm putting this in the form of emotion. [1:16:52, 1:17:02]: So that staff can continue their due diligence. But they need to know what distance okay. Well that is the research. Okay. Do I need to include that in my motion? Okay. [1:17:03, 1:17:09]: I don't have a distance. Okay, fine. So Mayor Ford. Yes, ma'am. [1:17:09, 1:17:12]: Let me move forward with my motion. Okay, I'll repeat it. [1:17:12, 1:17:13]: So that it is clear. [1:17:14, 1:17:14]: Go ahead. [1:17:15, 1:17:15]: I like [1:17:16, 1:17:17]: To make a motion. [1:17:18, 1:17:19]: To task staff. [1:17:19, 1:17:21]: We've doing the research and due diligence. [1:17:22, 1:17:23]: To include [1:17:23, 1:17:24]: The text amendment [1:17:25, 1:17:32]: That requires that homeowners who live within a certain distance, whatever that certain distance is [1:17:33, 1:17:34]: That staff is researching. [1:17:36, 1:17:40]: Those homeowners should be notified. I believe it's five hundred. [1:17:41, 1:17:42]: Yards. [1:17:43, 1:17:45]: I think that's common, but I don't know. [1:17:46, 1:17:47]: The attorney is doing the research. [1:17:47, 1:17:49]: Is there a second to that motion? [1:17:50, 1:17:51]: Is there a second to that motion? [1:17:52, 1:17:53]: Mayor Ford. Yes, sir. [1:17:55, 1:17:58]: I will second that and and I I think it is reasonable. [1:17:59, 1:18:11]: Um for those entities within that motion, I think it's reasonable. So therefore I second that motion for the homeowners and the citizens of the great city of Stockbridge. All right. [1:18:12, 1:18:15]: Motion is made the second. All in favor of the motion, please indicate. Discussion. [1:18:16, 1:18:36]: What's your what you're discussing? So Mr. I understand come back to the podium. Go ahead. What's your discussion, sir? Oh well, I got a question anyway. What's your question? So so right now, what is the notification requirement? 300 feet. So 300 feet. So you're asking for an additional 200 yards. Is that what you're asking for? Is that what the recommendation? [1:18:36, 1:18:36]: [4719.4, 4723.4]: S are you asking for an additional two hundred yards? At five hundred feet. [1:18:43, 1:18:48]: I am asking that the real estate attorney or zoning attorney [1:18:48, 1:18:50]: And the senior planner. [1:18:50, 1:18:53]: Continue with their due diligence. [1:18:53, 1:18:54]: So they can determine. [1:18:55, 1:18:55]: The best [1:18:56, 1:18:57]: Distance. [1:18:58, 1:19:00]: So that those homeowners are notified. [1:19:01, 1:19:12]: I'm not into zoning and planning. That's not my expertise. But that is what staff does. Right, but but my currently excuse I'm sorry. Currently homeowners [1:19:13, 1:19:15]: who are adjacent. [1:19:15, 1:19:17]: to the proposed development. [1:19:17, 1:19:19]: are being notified. [1:19:19, 1:19:23]: Well their neighbors next door to them are not being notified. [1:19:23, 1:19:25]: So my motion [1:19:25, 1:19:26]: Is [1:19:26, 1:19:27]: Attempting [1:19:28, 1:19:31]: To make sure that all homeowners who are affected. [1:19:31, 1:19:36]: Be notified, not just those whose property abut [1:19:36, 1:19:38]: The proposed development. [1:19:38, 1:19:47]: I want every homeowner, every business that is within whatever distance, the zoning attorney and the senior planner. [1:19:47, 1:19:48]: Whatever they determine. [1:19:49, 1:19:58]: One second, but you said Ryan just in a second ago, but three hundred feet, right? Is that what it is? Yes, that's what it's that's what it currently is. So we we probably just uh [1:19:59, 1:20:05]: Look at some other municipalities and see what their distance requirements are and get a average and bring it back. [1:20:05, 1:20:25]: All right. Right. And my follow-up to that is again, I I just want to make sure you understand if they come back with three hundred, we're not gonna change. So if you make a recommendation and say you this is what you want, then that can actually be a goal for them to seek that. But if they come back and they go to these surrounding jurisdictions, [1:20:25, 1:20:39]: And they come back with, well, you're 300. It might be, it could be less. So understand what you're asking for, what you're asking for. The number could come back with, we're doing more than other jurisdictions already. So you're comfortable with it if they actually reduce it. [1:20:40, 1:20:47]: I motion's been made and been seconded in this aspect. Any further discussion? Clarification. Discriminator. Clarification. Clarification, please. [1:20:48, 1:20:51]: I thought I heard in the motion it says five hundred feet. [1:20:52, 1:21:01]: There was no there wasn't no there was you didn't put it. Right for the staff to research and find out what's best. Okay. [1:21:02, 1:21:04]: So there is no specification, correct? [1:21:04, 1:21:07]: That's my understanding. [1:21:08, 1:21:10]: Councilwoman Barrow confirm. [1:21:12, 1:21:17]: I'm okay with it. I just wanna make sure that that's understood that it could come back less, you know. [1:21:20, 1:21:21]: Well, okay. [1:21:22, 1:21:24]: Hopefully everybody understands the motion. [1:21:25, 1:21:41]: But because the motion is saying when staff come back they make the recommendation to us that they will make we're going to approve it. But what if they come back with less than what you have? We'll have we'll have further discussion obviously. When that when that comes back, we'll have further discussion. We'll have further discussion when it comes back. All right, all all in favor of motion, please indicate. [1:21:42, 1:21:42]: Two. [1:21:43, 1:21:53]: Name decision. All right. Name decision. All right, thank you. Well no on that piece. One more s one second. That's on that piece though. But outside of that, that's that's a that's an additional tasking, but we still have the [1:21:54, 1:21:57]: uh the actual approval process for what we've done thus far. [1:21:57, 1:22:00]: It's my assumption here. Oh I approve. So moved. [1:22:00, 1:22:01]: Okay, is there a second? [1:22:02, 1:22:04]: Miss b Miss Berry Second, all favor, please indicate. [1:22:05, 1:22:08]: Well thank you. That's unanimous also. Okay, there we go. All right, thank you very much. [1:22:08, 1:22:13]: All right, so we're back on task here. New contract for civil engineering services. [1:22:13, 1:22:26]: Approval and mayor's execution of a month to month contract for civil engineering services with Whitley Engineering Incorporated, the authorization for the city mayor to execute all contract related administrative and budgetary actions. Mr. Ryan, please. [1:22:26, 1:22:41]: Uh yes, our um uh emergency contract for engineering services expires on um March thirty first of uh this year, w rather at the end of this month. So we're asking for an extension on a month to month basis until our RFP process can be completed. [1:22:43, 1:22:45]: Okay? Questions, concerns? [1:22:45, 1:23:05]: So right now we're doing so how how long do we anticipate the the RFP process taking? So right now we're just going month to month with the existing until that happens. So when do we expect currently he's on a six-month emergency services contract, which expires, like I said, on the 31st of this month. So right now the RFP uh will start [1:23:05, 1:23:08]: [4988.6, 4993.0]: Um, so we anticipate that being finished by March. I mean by May. [1:23:13, 1:23:15]: So he'll be on a contract for [1:23:16, 1:23:17]: Maybe two to three months. [1:23:17, 1:23:28]: on a month to month basis and it won't exceed a hundred and eighty days. We'll we'll have a um we plan to have a permanent consultant in for for one whole year with four year renewable terms. [1:23:29, 1:23:45]: Okay, my my question to follow up would be that we we put'em on a six month and we kinda at this point we're kinda at the last minute saying, Okay, well let's do let's make a month a month instead of putting out the RP ahead of time. We've been we've been working on it, so [1:23:46, 1:23:47]: All right. [1:23:47, 1:23:50]: [5030.4, 5036.2]: Will the month to month contract on an average be more than what we were currently playing in the six month? [1:23:56, 1:24:00]: Uh y yes, it would be um five hundred dollars more. [1:24:01, 1:24:21]: Uh the when he came in on the emergency contract, um his scope has since increased significantly, the amount of responsibilities and duties that he have. And the forty five hundred is far below market value. So um he w asked for an increase uh more than that, but uh I can only negotiate five hundred dollars more. But his [1:24:21, 1:24:28]: His duties, uh tasks and responsibilities have it have increased significantly from what was originally proposed. [1:24:28, 1:24:43]: So on average, what is our per month I know we did a six month, but what was our per month cost for then and what will it be now? Uh we pay currently we pay forty five hundred dollars a month for engineering services. And on this month to month basis we'll be paying five thousand a month. [1:24:47, 1:24:48]: Which is still far below market. [1:24:49, 1:24:50]: And what what's market? [1:24:51, 1:25:00]: Uh uh if we were to hire our own engineer, it would cost the city uh with fringe benefits, it would cost us a minimum of a hundred thousand at least. [1:25:00, 1:25:02]: Annually. Annually, yes, sir. [1:25:11, 1:25:12]: Good, sir. Anything else? [1:25:16, 1:25:21]: You good. Okay. Any other questions from the council? If not, I need a motion to accept this proposal. [1:25:23, 1:25:34]: Yes, ma'am. Go ahead, please. Do you have a question? I do. I'd like for us to add a not to exceed amount. And I know that you're requesting that we approve this month to month. [1:25:35, 1:25:41]: Mm-hmm. Until the award. Okay. So until you said May? [1:25:41, 1:25:49]: Uh I'm not it's it's it can last up depending on how the RFP process goes. We anticipating we'll we'll award the contract to somebody. [1:25:49, 1:25:53]: in June. The RFP process will end [1:25:54, 1:26:00]: And sometimes in May. So we hope to award the contract to someone and it will start in June. [1:26:01, 1:26:05]: Can we add a not to exceed amount of twenty thousand dollars? [1:26:06, 1:26:07]: Um [1:26:09, 1:26:11]: Yes. Mr. Gardner. Yes. Mm-hmm. [1:26:12, 1:26:17]: Okay. And um that ye will bring us back the award. [1:26:18, 1:26:21]: Yes, when the at the RFP, yes, we'll have to bring that back to you. Yes. [1:26:21, 1:26:22]: July first. [1:26:23, 1:26:27]: Yes, h hopefully yes. Yes. If everything goes as as anticipated. [1:26:29, 1:26:29]: Mm. [1:26:30, 1:26:30]: Okay. [1:26:30, 1:26:34]: Right. So give me a recommendation so I can include it in my motion. [1:26:35, 1:26:36]: Uh recommendational [1:26:37, 1:26:37]: That the [1:26:38, 1:26:47]: uh make a motion to uh do a a emergency a month to month contract not exceeding four months and not exceeding twenty thousand dollars. [1:26:48, 1:26:51]: Okay. Mayor Ford, I'd like to make a motion. Go right here. [1:26:53, 1:26:58]: Um, I'd like to approve a month to month contract for [1:26:58, 1:27:00]: Whitley Engineering. [1:27:01, 1:27:14]: for emergency civil engineering services for four months not to exceed twenty thousand dollars. Sir Okay, Ms. Alsa, I second that motion of you please indicate. [1:27:15, 1:27:17]: Thank you, Mr. Anderson. [1:27:18, 1:27:38]: Announcements of upcoming meeting events.
