[0:04:15, 0:04:29]: On the agenda item number six, it's asking for approval of the minutes from April eighteenth, twenty twenty four. I think that's a typographical error. The first case we have tonight is case CP twenty twenty four dash zero two, the comprehensive plan amendment case. And it's in the properties located in Council District Four. [0:11:01, 0:11:17]: Consideration of request for a comprehensive plan amendment for property at one eleven Old Conyers Road to change the property's future land use designation of low density residentials to special purpose. [0:11:18, 0:11:25]: to allow for the struct construction of a mixed use development including commercial and residential usage. [0:11:26, 0:11:28]: The applicant is Charlie Hathawa. [0:11:29, 0:11:32]: On behalf of First National Land Trust LLC. [0:11:33, 0:11:47]: The property is located in land lot sixty eight of District twelve with six point seven one acres more or less within the city limits of Stoppridge. [0:11:50, 0:11:50]: Go ahead, Sarah. [0:11:52, 0:12:07]: Thank you, Mr. Chair. Um my name is Gordon Linton, as mentioned, uh Platter one for the city of Stockbridge, and I'm here to present the cases for RZ twenty twenty-four-zero two, CP twenty-four-zero two, and VR twenty-four-zero one. [0:12:12, 0:12:32]: These are the case facts. The applicant is Charlie Hiretower. The owner is Solutions Development LLC. And the agent is Charlie Hiretower. The number of proposed units per acre is 29.8 units per acre. The address, as mentioned, is Water Level Old Connors Road, with the number of acres being 6.71. [0:12:32, 0:12:52]: And the project characteristics is that it's vacant, it's undeveloped with an intermittent stream that's located near the southeast corner of the site, and at least three acres of properties of the property is in the Brush Creek wetlands. Currently, the future land use designation is low density residential, and the current zoning of the property. [0:12:54, 0:12:56]: It's mentioned below. Okay. [0:13:00, 0:13:00]: Uh [0:13:00, 0:13:20]: So this is the vicinity map, and this is the site right here. It's adjacent from the public shopping center. And you also have the Stockbridge Lakes Bed and Breakfast. And you also have the church, the God First Breakthrough Ministries, the Public Works Department, you got the corner store, Downtown Food Market, Cochrane Park, and you have series of topics. [0:13:20, 0:13:27]: Townhomes, which is the Diamante Townhomes, and he also had the recently approved 55 Villie Hill Road Townhomes. [0:13:31, 0:13:35]: This is the aerial photo with the side plan, which is located right here. [0:13:40, 0:13:51]: So this is the site visit that we did on May twenty-first, twenty twenty four. This is the site, uh it's vacant. And over here to the far right is uh Brush Creek uh wetlands. [0:13:54, 0:13:56]: Over here, this is the location of the stream. [0:13:59, 0:14:06]: And the property is adjacent from the public's shopping center. Um one of the retail stores is JSJ Cleaners. [0:14:10, 0:14:13]: And this is the access entrance to the proposed mixed use development. [0:14:14, 0:14:14]: Right here. [0:14:17, 0:14:25]: And this is the location of the stream. And as mentioned earlier, this is location of the Broad Street Common Wetland, which is located over here. [0:14:29, 0:14:36]: So as mentioned, three acres of the studject property are located on the Brush Creek wetlands, which is shown highlighted in the orange. [0:14:41, 0:14:44]: And this is the presentation for the CP twenty four dash zero two. [0:14:45, 0:14:57]: The applicant's request is to change the future current future land use designation from low density residential to special purpose to allow for the construction of a mixed use development that will include both commercial and residential uses. [0:14:59, 0:15:01]: And this is the special purpose in the acre. [0:15:03, 0:15:12]: Since the proposed density has a high density rate of 29.8 units per acre, the applicant requested a change from low density residential to special purpose. [0:15:13, 0:15:15]: And this is his definition? [0:15:18, 0:15:34]: And the this is the future land use map, which is shown, the property is shown in green. And the area is surrounded by the future current land use destinations of low density mixed use, low density residential, public institution, and park recreation conservation. [0:15:37, 0:15:57]: And this is the surrounding land use destination as mentioned. You have the property to the north, which is public shopping center, which is low density mixed use, along with the Stockbridge Lake Bed and Breakfast. You have the downtown Food Mark Corner Store to the south, along with the Public Works Department, which is currently with the future land use destination of low density residential. [0:15:57, 0:16:09]: Property to the east, which is the Godfirst Breakthrough Ministries, is public institution. And property to the west, which is Cochrane Park, is has a current future land use designation of park, recreation, and conservation. [0:16:11, 0:16:13]: And this is the surrounding land use densities. [0:16:17, 0:16:27]: Densities of the surrounding subdivisions as shown here ranges from one unit per acre to sixteen point three six units per acre, and the applicant has twenty nine point eight zero units per acre. [0:16:30, 0:16:36]: And this is the surrounding land use density map. And the site is shown here along with the other surrounding land use densities with the number of [0:16:37, 0:16:38]: Density units per acre. [0:16:41, 0:17:01]: As mentioned in the project information, the applicant proposes to build a mixed-use development that will consist of a five-story building with 200 apartment units and commercial spaces that will be located on the ground floor. As mentioned earlier, the subject property has a current future land use designation of low density residential. However, due to the high proposed density of 29.8 units per acre, [0:17:01, 0:17:07]: The applicant has requested to change the future land use designation from low density to special purpose. [0:17:10, 0:17:22]: The key points to highlight it from the staff analysis that we did is that the property is the proposed mixed use development is consistent with the pro current comprehensive plan goals and policies, which are shown here on the far right. [0:17:25, 0:17:34]: Among them is to provide additional housing in the downtown core, and it will provide a mixture of housing options to attract young, professionals, singles, and small families. [0:17:36, 0:17:54]: And the other key point from the staff analysis is that the proposed mixed use development is suitable for the site since it's point zero seven miles away from both the Stockbridge Amphitheater and the downtown air. It will provide a walkable community since it is close to both Cochrane Park and the public shopping center. [0:17:58, 0:18:00]: And a staff recommendation is for approval. [0:18:04, 0:18:07]: Any questions for staff from the commission? [0:18:10, 0:18:30]: Question. Um first let me say I think this is a great proposal for uh the comprehensive plan amendment. Um one of the questions I had was you said that a part of the development is in the wetlands, of the actual development, how much of the the actual development is in the wetlands? [0:18:39, 0:18:44]: Three acres. Three three point eight seven acres. Thank you. That's all I have to you. [0:18:47, 0:18:48]: Мне это пласт. [0:18:55, 0:18:56]: Perfect. [0:18:56, 0:19:00]: And this is the presentation for RZ twenty twenty four dash zero two. [0:19:02, 0:19:08]: The applicant's request is to rezone the property from SR, which is suburban residential, to PUD, which is plan [0:19:19, 0:19:23]: You have to you have to read it to the record. [0:19:25, 0:19:26]: I don't know what it is. [0:19:33, 0:19:35]: Is the appetite present? [0:19:35, 0:19:37]: Would you come forward and state your name? [0:19:40, 0:19:48]: And tell us why you're here. Good evening, everyone. Charlie Hotel, applicant of uh 111 Old Congress Road. [0:19:49, 0:19:50]: Okay, go right ahead, sir. [0:19:51, 0:20:11]: And exactly what am I requesting? I I think Gordon did a great job, but I can kind of recap what he done. It's my speaking to the microphone, please. Yes, sir. It's my understanding that the subject property has a hardship, which is the three acres approximate in the wetlands. Therefore, the need for the series of applications. [0:20:11, 0:20:18]: That were submitted is required in order to facilitate this project. The first one being the [0:20:18, 0:20:24]: the rezoning from uh suburban res residential to uh PUD, the second one being the [0:20:25, 0:20:26]: Amendment to the comprehensive plan. [0:20:27, 0:20:27]: Oh from [0:20:28, 0:20:48]: Low density to special purpose. The third one being the variance that we're requesting to increase the density from 24 units per acre to 29 units per acre. The fourth one being to decrease the parking. I believe two bedrooms require parking 1.75 units per two bedrooms. [0:20:48, 0:21:02]: bedroom to reduce that to 1.25 units. And for the one bedroom, I believe the requirements is 1.25 units per one bedroom studio to reduce that to one car per one bedroom. [0:21:02, 0:21:18]: The last but not least, I believe the um ratio for commercial versus residential by default is 75% to 25% ratio. Um, we would like to reduce that from 85.5% to twelve point five percent. [0:21:19, 0:21:27]: And that is our request. And the reason for that request is simply based on the hardship that the property has presented with half of the property being in the wetlands. [0:21:31, 0:21:34]: Any questions for Mr. Hatow from the commission? [0:21:34, 0:21:39]: Yeah, I have a couple of questions. Um have we done a traffic study? We have. [0:21:40, 0:22:00]: And also, have we done a study about the wetland in terms of the stream? Uh is that stream gonna be relocated? Uh is it gonna cause any flooding area? It would not impact the part that uh studies is underway for the wetland. As far as the traffic study, it does not impact apart that. [0:22:00, 0:22:06]: either. Uh I'm unable to speak intelligently on a traffic study. I will lead it to the traffic engineer. [0:22:07, 0:22:17]: And my next question is, have you talked to the the neighbors around there or Yes. We did a committee meeting, received feedback, no concerns or reservations. [0:22:18, 0:22:20]: Now my next question is [0:22:21, 0:22:41]: What are you gonna do about water runoff? That's a possibility that uh you may flood property by redeveloping the land, things to that nature. I'm quite sure that's what they're gonna ask. Definitely great question. And um we lead that to the civil engineers to propose a solution. Uh from what we see, we don't see any [0:22:41, 0:22:52]: impact the actual structure is not in the wetlands. A partial of the parking would be rearranged off the wetlands, but as we see, we doesn't see any impact. [0:22:54, 0:22:56]: Thank you. Yes. [0:22:56, 0:22:57]: Any more questions? [0:22:57, 0:23:17]: I have a question. Um one I just want to say thank you because anytime we have development for young professionals specifically, I'm always for it. But um just confirming, you did say you did complete an impact study for the development, right? Traffic study. Okay. Um any community meetings with the with that surrounding area? [0:23:17, 0:23:37]: We uh yes, we approximately mailed out 23 letters to 23 partials within 500 feet of the subject property, which is a requirement based on the city of Stockbridge. And we took summary of that meeting and no reservations from the community. Okay. I'm just looking at the area because it's you right beside the park, so now you're looking at kids and [0:23:37, 0:23:43]: in that area at a high volume. Um another thing I wanted to ask, uh [0:23:45, 0:23:55]: What was the last thing? Oh, did you by chance, uh going back to like the streams and s and like water flooding, did you s like think about water tables for the property at all? [0:23:55, 0:24:14]: Yes, we are proposing um underground retention for the project, but again, I I believe we're at the point where it's pretty premature and there's a significant investment that needs to go into the planning and studies and the proposed site plan was a preliminary to at least address this phase. [0:24:14, 0:24:15]: Okay, thank you. [0:24:18, 0:24:19]: Thank you, sir. [0:24:20, 0:24:21]: Thank you. [0:24:38, 0:24:38]: Yes. [0:24:47, 0:24:48]: I'm sorry I can't hear you. [0:24:54, 0:24:55]: Go right ahead. [0:24:56, 0:25:02]: We do have a comment or a question by a Miss Johnson uh regarding this property. [0:25:03, 0:25:09]: Okay. Uh I would ask you to hold that until we open it up for public hearing. [0:25:13, 0:25:17]: Місте Антон, до єfer да ви го ін [0:25:18, 0:25:23]: rezoning in various before we open it up for public or do we Yes yes, sir. Okay. [0:25:29, 0:25:31]: The next case that I have [0:25:33, 0:25:53]: It's the VR, I'm sorry. It's RZ 2024-02. It's a consideration of a request for rezoning of the property at 111 O'Cunas Road to rezone the property from SR, which is suburban residential, to PUD. [0:25:53, 0:25:56]: D plan unit development. [0:25:56, 0:26:03]: to allow for the construction of a mixed use development including commercial and residential uses. [0:26:04, 0:26:20]: The applicant is Charlie Hartower on behalf of First National Land Trust LLC. The property is located in land lot sixty eight of District twelve with six point seven one acres more or less in the city of Stockbridge. Go ahead, Staff. [0:26:22, 0:26:26]: Okay, so this is the presentation for R Z twenty twenty four dash zero two. [0:26:29, 0:26:42]: As mentioned, the applicant's request is to rezone the property from SR, suburban residential, to PUD, plan unit development to allow for the construction of a mixed-use development that will include both commercial and residential uses. [0:26:45, 0:26:46]: This is the zoning map. [0:26:47, 0:26:51]: And the property is surrounded by b C two. [0:26:52, 0:26:55]: C three and O R. [0:27:00, 0:27:06]: This is uh location of the subject property. Uh part of it is in the Parkway Mixus Overlay District. [0:27:14, 0:27:23]: And the subject property is part of the tax allocation district otherwise TAD, which is designed to attract quality development into distressed redevelopment area. [0:27:26, 0:27:35]: And this is a LCI study that was conducted by by in twenty twelve, which labels the subject area as a growth area, which means that is recommended for growth. [0:27:37, 0:27:55]: And this is the side plan, so he has uh therapy garden, a pergola, which is sitting per pergola, uh grill, trash bin, playground, bicycle parking, and this is the location of the ground parking, and this is a dog park with mulch. [0:27:57, 0:28:03]: And the adult pool is in labeled in blue and the retail space is labeled in orange and you have another bicycle parking. [0:28:08, 0:28:13]: And this shows how far the proposed mixed use development is from the amphitheater and the downtown area. [0:28:16, 0:28:20]: And this is the development data summary for the site plan of the property. [0:28:28, 0:28:30]: And this is the exterior of the townhomes. [0:28:36, 0:28:45]: And this is the first floor plan of the proposed mixed use development. You have the three retail use spaces located here, along with the number of parker spaces here. [0:28:49, 0:29:09]: And as mentioned earlier, uh the applicant proposes to build a mixed-use development that consists of a five-story building with 200 apartment units and commercial spaces that will be located on the ground floor. Of the proposed 200 apartment units, 95 will be studio, 95 will be one bedroom with one bathroom, six will be two bedroom with two bathrooms. [0:29:09, 0:29:27]: And forward will be three bathroom units with two bathrooms. There will be a total of three retail spaces with a combined total of fifteen thousand square feet on the first floor of the proposed building. The proposed mixed use development will provide vehicular access to the site with a deceleration lane that will be located along Oconyous Road. [0:29:33, 0:29:41]: And the key points to prov uh from the staff analysis is that it is consistent with the goals and policy of the comprehensive plan. [0:29:42, 0:29:42]: Was just mentioned here. [0:29:44, 0:29:47]: It is consistent with the unified development code. [0:29:50, 0:30:10]: And the three positive effects is that this will be the first mixed-use development in the downtown area, Stockbridge. It will provide alternative type of use housing for young professionals who are looking for apartments, and additional of the retail spaces will provide additional job opportunities. And both the LCI and the downtown [0:30:10, 0:30:15]: Residential and retail market analysis encourages growth in the downtown area. [0:30:18, 0:30:38]: And on page seventy six of the downtown market retail analysis said that the position stop rates for change in local, regional, and national market and demographic trends, particularly the needs of Asian residents and the so-called millennials, the downtown must be rid of revitalized in a way that builds on its historic character and position as a walkable, [0:30:38, 0:30:45]: Mixed use alternative to surrounding areas, many of which will be less suitable to adapt to those changes, which the proposed development meets. [0:30:50, 0:30:55]: A water service is available and the they did a traffic impact study. [0:30:56, 0:31:06]: which is shown on this screen, and it will generate a total of one thousand four hundred and seventy eight net daily trips with seven hundred and thirty nine inbound and seven hundred and forty outbound. [0:31:09, 0:31:29]: And staff recommends approval with conditions to rezone the property from SR to PUD with the following conditions. The number of proposed units will be reduced from 200 to 160, 23.84 units per acre, due to the maximum density allowed by the requested special purpose future land use destination, which is [0:31:29, 0:31:49]: 24 units per acre. Clock cameras will be located at the entrance of the mixed-use development. On the eastern side of the subject property, a 25-foot land strip will be extended past the pool area found on the conceptual site plan. The front facade of the residential building shall be comprised of not less than 50% of the combined material. [0:31:49, 0:32:09]: Such as brick, stone, or stucco, or a combination of brick and stone. The remaining 20% may be comprised of stone, stucco, shake, or andor cement fiberboard siding. The side and rear facade of the residential building should be comprised of any combination of primary materials, including brick, stone, and secondary materials. [0:32:09, 0:32:29]: Included stucco, shake, and/or cyber cement fiber board, but not to exceed 30% of the entire building. The colors should consist of a cohesive complementary palette, and limited use of the accent color is permitted as long as they are not bright or fluorescent and complement of the [0:32:29, 0:32:35]: The overall palette of the material and the proposed mixed-use development should not exceed four stories. [0:32:39, 0:32:41]: Any questions for stay from the commission? [0:32:48, 0:32:49]: No questions? [0:32:52, 0:32:52]: Thank you, Gordon. [0:32:55, 0:33:07]: I won't ask the applicant to return unless you have something to add or if you if the commission have questions that you need to answer. [0:33:14, 0:33:15]: Okay, no questions? [0:33:17, 0:33:32]: The next case is the rezoning RZ-2024-02. This is in Council District 4. Consideration of request to rezone. I'm sorry. [0:33:33, 0:33:34]: What's the [0:33:35, 0:33:47]: Oh yeah, you're right. You're right. Case VR twenty twenty-four dash zero two. Variance case VR dash twenty twenty four dash oh one. [0:33:48, 0:33:52]: It looks like a typographical arrow, but [0:33:52, 0:33:54]: I'm reading what it says. [0:33:54, 0:33:58]: Council District four, a consideration of requests for three variances. [0:34:00, 0:34:05]: As are listed below for the property at one eleven O Cunha Road. [0:34:06, 0:34:12]: To allow for the construction of a mixed use development including commercial and residential uses. [0:34:13, 0:34:30]: The applicant is Charlie Hathawa on behalf of the First National Land Trust, LLC. Properties located in landlot 68 of District 12 with 6.71 acres more or less within the Stockbridge City limits. [0:34:31, 0:34:34]: The three requested variances are as follows. [0:34:35, 0:34:36]: Variance request one. [0:34:37, 0:34:44]: The variance to reduce the parking requirements according to the number of bedrooms per apartment unit. [0:34:45, 0:34:56]: Brother studio and one bedroom apartment units will have only one parking space instead of the required one point two five parking spaces per unit. [0:34:58, 0:35:04]: And the two bedroom units would ha have only one point two five parking spaces per unit. [0:35:04, 0:35:09]: Instead of the required one point seven five parking spaces per unit. [0:35:12, 0:35:13]: Fairness of question number two. [0:35:14, 0:35:19]: Variance to modify the ground floor retail square footage requirement. [0:35:20, 0:35:23]: By changing the residential to retail space ratio. [0:35:24, 0:35:28]: From the required ratio of seventy five percent. [0:35:30, 0:35:37]: twenty five percent to a proposed ratio of eighty seven point five percent to twelve and a half percent. [0:35:39, 0:35:50]: Variance request number three. Variance to increase the project's density from twenty-four units per acre to twenty-nine units per acre. [0:35:52, 0:35:55]: Mr. Linton, you may proceed. Yes, sir. [0:35:57, 0:36:10]: Again, Mr. Chair, if I may just read in the record the correct case number. It is VR dash two zero two four dash zero one. [0:36:10, 0:36:10]: Thank you. [0:36:16, 0:36:36]: As mentioned, the applicant is requesting three variances that found in the UDC. These variances are as follows: reduce the parking requirements according to number of bedrooms per apartment unit, whereby a studio and one bedroom apartment would have only one parking space instead of the required 1.25 parking spaces per [0:36:36, 0:36:45]: per unit and two bedrooms would only have one point two five parking spaces per unit instead of the required one point seven five parking spaces per unit. [0:36:47, 0:37:07]: The second variance is to modify the ground floor retail square footage requirement by changing the residential to retail space ratio from the required ratio of 75 slash 25% to reposed ratio of 87.5% slash twelve point five percent. And the third variance is to increase the project. [0:37:07, 0:37:11]: product density from twenty-four units per acre to twenty-nine units per acre. [0:37:14, 0:37:21]: So this is his parking the parking requirements that are found in section four point eighty four A of the Unified Development Code. [0:37:22, 0:37:37]: This is the current parking requirements, which is the one bedroom of efficiency unit, which is 1.25 parking spaces per unit, and the two bedroom unit, which is 1.75 parking spaces per unit. And the request from the applicant is to reduce it from one bedroom [0:37:38, 0:37:45]: Or efficiency unit one point parking spaces per unit and the two bedroom unit to one point two five parking spaces per unit. [0:37:47, 0:38:07]: And this is proposed. The studio will have 195 units, which a total of 119. The one bedroom will also have 95 with 119 parking spaces. The two-bedroom will have six units with 11 parking spaces. And the third three-bedroom will be will have four units with eight parking spaces. [0:38:07, 0:38:15]: Spaces. So the total residential parking spaces is 200, and the number of parking spaces will be 257. [0:38:17, 0:38:20]: And this is the overall proposed number of parking spaces. [0:38:21, 0:38:30]: It will be 257 total with seventy-nine commercial parking spaces, which brings the overall number of parking spaces to 336. [0:38:32, 0:38:45]: And this is the required. Staff discovered that the increment parking calculations were used. Therefore, the required parking calculation resulted in two hundred and eighty-seven residential parking spaces with [0:38:45, 0:38:59]: Seventy nine totaling three hundred and six parking spaces. The applicant did not provide the proposed total reduced parking spaces, therefore staff recommends reducing the residential parking spaces by thirty parking spaces totaling three hundred and thirty six parking spaces. [0:39:06, 0:39:26]: And this is the key point from this from the staff report is that three acres of the subject property is located in the Brush Creek wetlands. Therefore, the developer is likely to color several hardships due to the wooded areas, their varied elevations, and the location of the Brush Creek wetlands, and it is consistent with the UD. [0:39:26, 0:39:40]: DC since it will allow the developer to comply with the parking regulations, alleviate the number of potential cars that will be located on the proposed mixed use development, and it will eliminate impervious parking spaces that will be located on the mixed use development. [0:39:43, 0:40:03]: Based on the staff analysis above, the planning and zoning staff therefore recommends approval for the warrant for the following variances. The first variance will be approved. And the second, we couldn't find it in this in the UDC development code, therefore, it will be non-applicable. And the third, which is to increase the project density from 24 units. [0:40:02, 0:40:20]: units per acre to twenty nine units per acre. That is approved with conditions, which is the number of proposed units will be reduced from two hundred to one sixty units, twenty three point eight four units per acre due to the maximum allowed by the required special use, special purpose future land use destination. [0:40:31, 0:40:32]: Are you done? [0:40:36, 0:40:43]: Mr Chair, if Gordon just clarified number one, the number of parking spaces that we're approved. [0:40:44, 0:41:04]: Okay, so to reduce the parking spaces according to number of bedroom units per apartment unit, whereby a studio and one bedroom apartment units will have only one parking space instead of the required 1.25 parking spaces per unit, and the two bedrooms will only have 1.5 parking spaces per unit. And as mentioned, staff has discovered that. [0:41:04, 0:41:24]: That the incorrect parking calculation and the parking reduces were used, and therefore the required parking calculation resulted in 287 residential parking spaces with 79 retail, totaling 366 parking spaces. The applicant did not provide the proposed total reduced parking spaces, therefore staff. [0:41:24, 0:41:34]: Staff is recommended to reduce the residential parking spaces by thirty parking spaces, which will result in a total of three hundred and thirty-six parking spaces. [0:41:37, 0:41:40]: Any questions for staff from the commission? [0:41:45, 0:41:47]: No questions? Thank you. Go on. [0:41:50, 0:42:00]: This is a public hearing, so this is how we will conduct it. If there is anyone present who wish to speak in favor [0:42:01, 0:42:09]: Of just development, the comprehensive plan amendment, the rezoning, and the variance request. [0:42:10, 0:42:17]: If you are in favor, we ask that you s form a line in the center aisle here. [0:42:21, 0:42:22]: At a pros the podium. [0:42:24, 0:42:28]: Fill out a form, give it to the secretary if you haven't already done so. [0:42:30, 0:42:31]: Anybody in favor of the [0:42:34, 0:42:48]: Okay. Seeing none, I will ask the questions of anybody present who is opposed to the project, the comprehensive plan amendment, the rezoning, and the variance requests. [0:42:51, 0:42:53]: Into one opposed. [0:42:58, 0:42:59]: I see one individual. [0:43:01, 0:43:02]: Uh uh [0:43:03, 0:43:06]: You may approach the podium since you're the only one. [0:43:08, 0:43:10]: Hope you feel audible. [0:43:10, 0:43:13]: Okay. Give us your name and address please for the record. [0:43:14, 0:43:25]: Hi, I am actually Pastor Natasha Johnson. I'm from God first breakthrough one one five Old Conyers Road. We just had some questions. Um I don't think we're either opposed, we just had some concerns and questions. Is that okay? [0:43:26, 0:43:34]: Questions for commission or the staff or the staff and the commission regarding the overall project. [0:43:34, 0:43:35]: Go right ahead. [0:43:35, 0:43:44]: Okay. So just let me just stay up front, we are yes. I'm sorry, missage. Can you make sure your green light is on? It is. Perfect, thank you. Can I am I not loud enough? [0:43:44, 0:43:52]: Oh, okay. So um we're very excited about the f forward vision for the city of Stockbridge. We love the [0:43:52, 0:44:12]: comprehensive plan and we're excited about the potential that um, you know, the new things that Stockbridge is bringing in. Um the only questions that we had is, you know, in keeping with overall the city of Atlanta has been known for not having the right infrastructure in place prior to growth and expansion. [0:44:12, 0:44:12]: Yeah. [0:44:12, 0:44:22]: And while we appreciate bringing that many residents into the city of Stockbridge, our major concern is traffic and what it would bring. Um [0:44:22, 0:44:25]: Аз на част the [0:44:25, 0:44:26]: Um [0:44:26, 0:44:27]: The [0:44:27, 0:44:44]: vehicular traffic but also foot traffic. Um and we don't see part of the plan as far as expansion. We know that there's a deceleration lane that's planned at some point. Um are there walkways, etcetera. Even like I was driving down uh [0:44:45, 0:45:05]: East Atlanta yesterday and uh during Juneteenth, and someone just stepped out in front of my vehicle. You know, there are no clear walkways or identified pedestrian crossings. I mean, those are the questions that we have, um, considering that this is targeted for young professionals and small families with. [0:45:04, 0:45:08]: the park being across the street for Co Cochrane Plan. [0:45:08, 0:45:11]: Cochrane Clark, we anticipate that. [0:45:11, 0:45:14]: There will be additional pedestrian traffic. [0:45:14, 0:45:33]: And has there any thought been given to that? Um, the question that you asked, Mr. Williams, regarding the wetlands, that was one of the questions that we had as well. Um, and what thought and how they are planning to work around that and the impact to flooding as well as infrastructure. So we appreciate that. Um [0:45:34, 0:45:47]: I think most of the questions have been asked regarding what we want. The other one question we did have is there going to be any restrictions as far as ordinances for what kind of commercial um [0:45:47, 0:45:56]: establishments would be in that mixed use. Um we don't we would not like to see a liquid store. Um are there any restrictions? [0:45:56, 0:46:16]: uh going to be put in place by the commission regarding overall we are neither opposed to or in favor. We are just wanting to get more insight into what the plans are because it is adjacent to the church and we want to ensure that um, you know, the and as well as the buffer zone between the church and the apartment building is [0:46:16, 0:46:26]: sufficient to accommodate um any noise restrictions, etc. That's it. Thank you, Evan. Mr. Anderson, would you uh [0:46:27, 0:46:30]: Be willing to address some of her questions. [0:46:34, 0:46:47]: As as far as it relates to um walkability and pedestrian crosswalk, uh one of the city's primary goals is to make the whole entire area walkable and then and to have sidewalks. [0:46:48, 0:46:50]: on the side we all [0:47:06, 0:47:26]: The other concern she had, all that is currently governed by the UBC and state law, the liquor store cannot be any close proximity of the church. There are distant requirements, so chances are the liquor store won't be able to go there. And uh plus the city uh won't be able to issue any more liquor license until the city reaches a certain [0:47:25, 0:47:40]: population threshold we're in the process of issuing two new liquor licenses now and uh that area is not included in as one of the target areas for one of those new liquor stores. So the answer about the little store is nope, it won't be a little store. [0:47:40, 0:47:42]: And what was the other person? [0:47:45, 0:47:58]: The traffic set uh concerns and deceleration lane coming out from East Atlanta to Old Cottages, et cetera. [0:47:59, 0:48:00]: Well. [0:48:09, 0:48:14]: Thank you, Mr. Anderson. Is there anyone else who wished to speak in opposition? [0:48:20, 0:48:23]: Seeing none, the public hearing is now closed. [0:48:26, 0:48:33]: Uh Mr. Chair, I have a question from Mr. Go right if you don't mind. Are are we speaking? Speaking of the microphone, please. [0:48:33, 0:48:44]: Are we still going to uh have a road that comes from Rock Cory to O'Connors? Is that still in the in the makings, uh, Mr. Gordon? Do you know anything about that? [0:48:47, 0:48:49]: At one time they were gonna uh [0:48:51, 0:48:54]: Make a straight through through fare from uh [0:49:04, 0:49:24]: Uh if you don't mind, that'd be something I would like to get an answer to. Are we gonna develop uh a road from Rock Quarry to Old Kanye's Road? I'm I'm just putting it out there, okay? Mr. Tribado, thank you for your comment. I uh would encourage you to speak privately with Mr. [0:49:24, 0:49:33]: Anderson or whoever you deem necessary. The item is not on the agenda and I don't wanna take up a whole lot of time talking about that tonight. [0:49:37, 0:49:38]: The [0:49:41, 0:49:54]: Time now to vote on the cases that's before us. I need a motion with regard to comprehensive plan amendment KCP 2024-02 in Council District 4. [0:49:55, 0:49:57]: I need a motion from the commission, please. [0:49:58, 0:49:59]: Cheer. [0:49:59, 0:50:00]: Yes. [0:50:00, 0:50:13]: I make a motion to um approve comprehensive plan CP-2024-02 to include staff recommendations. [0:50:15, 0:50:17]: Or approval with the staff conditions. [0:50:18, 0:50:19]: Is there a second? [0:50:19, 0:50:21]: Mr. Chairman, I second that. [0:50:21, 0:50:28]: It's been moved by Mr Williams and second by Mr Plancham that the [0:50:29, 0:50:30]: C P [0:50:31, 0:50:39]: 2024 dash zero two comprehensive plan amendment case be approved. All in favor, let it be known by the sound of I. [0:50:39, 0:50:41]: I in your polls. [0:50:43, 0:50:47]: The eyes have it. Unanimous. The motion passes. [0:50:50, 0:50:52]: The next case is [0:50:53, 0:50:58]: Up for a vote is R Z twenty twenty four dash zero two resounding case. [0:51:03, 0:51:05]: I need a motion from the commission, please. [0:51:10, 0:51:20]: Chair. Yes, sir. Motion to approve the R Z dash twenty twenty four dash O two rezoning case. [0:51:21, 0:51:22]: Is there a second? [0:51:24, 0:51:31]: I second it. Harold. It's been moved by Mr. Williams and seconded by Mr. Thibodeau. [0:51:33, 0:51:42]: That we approve the rezoning case R Z twenty twenty four dash zero two. All in favor, let it be known by the sound of it. Aye. Aye. Any opposed? [0:51:45, 0:51:50]: The eyes have it. It's unanimous. The resulting case is approved. [0:51:53, 0:51:57]: The next case is the VR twenty twenty four-zero two. [0:52:00, 0:52:02]: Death three variances. [0:52:04, 0:52:06]: I need a motion from the commission. [0:52:07, 0:52:08]: Cheer. [0:52:08, 0:52:09]: Yes, sir. [0:52:09, 0:52:29]: Um before I make my motion, I did wanna uh tell the applicant. I had a few concerns with the actual d site development itself. So I would just implore you to work with community development. Um, Ryan and the entire team, they're amazing when it comes down to site plans. Cause there's some safety issues I kind of see, um, as well as just [0:52:29, 0:52:48]: really just that it's that wetland and that that stream that's really bothering me, especially in that area. Um with downtown development being built so far by mayor and council, I I I would have confer with them to try to reconfigure that. Um and then I would also [0:52:50, 0:52:52]: I also wanted to say [0:52:53, 0:53:05]: Something that I forgot. So I'm gonna make my motion. Um chair, I'd like to make a motion to deny variance one and variance two and approve variants three with the staff conditions. [0:53:09, 0:53:11]: Do I have a second to that motion, please? [0:53:13, 0:53:19]: Motion to deny variance one, variance two, and to approve variance three. Is there a second? [0:53:23, 0:53:29]: Do you mind if we have a conversation about that? I if you understand development [0:53:29, 0:53:36]: You can change anything you want to go in whatever direction. And also what I'd be concerned about basically [0:53:37, 0:53:39]: Is that they would know better. [0:53:39, 0:53:58]: about how to landscape property for flooding and anything else for drainage. So I personally would not deny that because you can make those changes and you can make re requirements to that. So that that's just a development issue that could l literally be controlled. [0:54:03, 0:54:07]: Since we have no second to the motion, then the motion fails. [0:54:08, 0:54:14]: Do we have an uh alternative motion? Mr. Tibetal, do you wish to make a different motion? [0:54:17, 0:54:21]: Yeah, I'd like to make a motion, uh present a motion that we'll approve of it. [0:54:22, 0:54:25]: Then we approve variants one, two, and three. [0:54:27, 0:54:31]: Yes. Okay, is there a second to that motion? [0:54:32, 0:54:41]: Mr. Planchon is seconded. It's been moved by Mr. Thibodeau and second by Mr. Planshon that we approve. [0:54:41, 0:54:42]: Yes, sir. [0:54:51, 0:54:54]: So the proper motion will be to approve one and three. [0:54:59, 0:55:03]: That's fine. You know, I would have appreciated it if you had written the script that way. [0:55:05, 0:55:05]: Yeah. [0:55:11, 0:55:18]: Did everyone hear that? Mr. Anderson has indicated that the variance request number two [0:55:21, 0:55:25]: should be taken off the table because it's not in the ordinance. [0:55:28, 0:55:32]: So I need a motion with respect to variance one and variance three. [0:55:36, 0:55:48]: Mr. Thibodeau, do you wish to make that motion? Yes, I'd like to present a motion that we uh put variants one and three back for the voting. [0:55:50, 0:55:57]: You making a motion to approval? Yes. I'd like to position it. Mr. Planchon is seconding. [0:55:58, 0:56:14]: It's been moved and by Mr Thibodeau that we approve variance one and variance three. And it was seconded by Mr. Plinchon. All in favor, let it be known by the sound of aye. Aye. Aye. Any opposed? Nay. [0:56:15, 0:56:26]: Mr Planchon and Mr. Thibodeau voted yay to approve the variance. Mr Williams voted nay to deny the variance. [0:56:27, 0:56:28]: The eyes have it. [0:56:29, 0:56:32]: Or the Yays have it, if you will, and the motion is approved. [0:56:47, 0:56:50]: Are there any project updates from staff? [0:56:53, 0:56:55]: Any comments from staff. [0:56:57, 0:56:59]: Any comments from the board, please? [0:57:02, 0:57:11]: No comments from the board. This meeting is adjoined. Thank you very much for attending. Thank you for your cooperation.
