[0:06:48, 0:06:50]: Mr. Chairman. Sure. [0:06:51, 0:06:54]: Thank you. Omitted item number five on the agenda. [0:06:54, 0:06:59]: Oh I'm sorry. You c absolutely correct. May I have a motion to adopt the agenda. [0:07:02, 0:07:06]: Um go ahead. I make a motion to adopt today's agenda. [0:07:07, 0:07:09]: And uh ha seconded it, Harold. [0:07:10, 0:07:10]: Second it. [0:07:10, 0:07:11]: Ms. Logan. [0:07:13, 0:07:30]: It's been moved and seconded. All those in favor let it be known by the sign of aye. Aye. Those opposed? Hearing none, the ayes have it. Uh the uh the agenda is adopted. Uh number six, approval of the minutes from April twenty-seventh, twenty twenty-three. [0:07:36, 0:07:37]: Mr. Chair, may I speak? [0:07:38, 0:07:45]: Go ahead, Mr. Thibodeau. The uh invocation was given by Mr. Dumas, so we need to make a correction on that. [0:07:48, 0:07:48]: Okay. [0:08:03, 0:08:05]: Any other changes or amendments? [0:08:29, 0:08:31]: May I have a motion to uh [0:08:32, 0:08:33]: Mr. Chair. [0:08:33, 0:08:36]: Go ahead, Ms. There's one correction. [0:08:36, 0:08:40]: That needs to be made for um the last variance case that we did. [0:08:42, 0:08:49]: So my vote was opposed to that last one. Would you repeat that, please? My vote was opposed for that last variance case, so it wasn't unanimous. [0:08:51, 0:08:53]: If that's what she wrote. [0:09:01, 0:09:03]: So we have two amendments. [0:09:03, 0:09:03]: Right. [0:09:05, 0:09:06]: Any others? [0:09:09, 0:09:16]: Have a motion to adopt the uh April twenty seventh agenda meeting notes uh as amended. [0:09:19, 0:09:30]: Mr. Chairman, I move that we adopt the uh minutes of the April twenty-seventh meeting with the necessary corrections as been articulated. [0:09:30, 0:09:31]: I second that. [0:09:32, 0:09:46]: It's been moved by Mr. Doomis and second by m uh Ms. Uh Kathleen, Ms. Mr. Nelson. All those in favor, let it be known by the sign of aye. Those opposed? Hearing none, the motion carries. [0:09:54, 0:09:58]: I believe the first item on the agenda is the city of Stock read a text amendment. [0:10:09, 0:10:20]: Did you read the item? Pardon me? You have to read the item. Did you read the item? No, I'll read it. Okay, all right. City of Stockbreak Text Amendment case number TX 202301. [0:10:20, 0:10:31]: Consideration of a text amendment to the stockbridge unified development code UDC in section two point five point two D twelve and section two point five three F eleven to allow [0:10:31, 0:10:49]: hookah bar lounges, cigar bar lounges, tobacco vape shops as auxiliary uses to the primary use of a restaurant or lounge. Currently the above uses are prohibited. Uses within the parkway, within the parkway mixed use, uh [0:10:51, 0:10:55]: Overlay District and the Downtown Village Overlay District. [0:10:56, 0:11:08]: Good evening. Um the purpose of this um text amendment is is to um allow hookahs, hookah bars, lounges, cigars [0:11:08, 0:11:28]: Lounges, tobacco, tobacco, vape shops, as an ancillary uses to the primary use of restaurants and lounges. Um a little background on this. The community development department has has received several inquiries to allow the above reference uses as ancillary or secondary uses. [0:11:28, 0:11:41]: Within a current restaurant lounge business operation within the city. This amendment would allow businesses within the downtown area and along major corridors the ability to expand their client base. [0:11:41, 0:11:48]: and offer a variety of uses and entertainment within a restaurant or lounge location. As an ancillary use, [0:11:49, 0:12:09]: It is the Community Development Department's recommendation that the sales revenue of ancillary use meet the sales revenue requirement of 51% food sales and 49% from hookah, cigar, tobacco, vape, or other sales. This is the current food sales to alcohol sales revenue model currently in place for representation. [0:12:09, 0:12:12]: Restaurants. Staff recommends approval of this text event. [0:12:14, 0:12:16]: Board, any questions? [0:12:18, 0:12:26]: I have one question. Yes, sir. We are all very conscientious of uh tobacco use. [0:12:28, 0:12:30]: Yeah. Um [0:12:31, 0:12:33]: And with the um [0:12:36, 0:12:40]: Tobacco having a uh being a carcinogenic. [0:12:42, 0:13:02]: How is that going to impact uh the people who come to these same establishments and uh you have hookahs and cigars, et cetera, going on? Um when when when when public facilities prohibit smoking, et cetera, in certain areas? Uh currently when we write the the regulations uh [0:13:02, 0:13:18]: Govern this program we will have that they have a re we will make a requirement for them to have a separate room with ventilation for the people who who indulge in hookah or cigar bar, to be in a separate room from the people that's in there eating food or going to the place exclusively for a restaurant use. [0:13:19, 0:13:22]: So in other words, if if if you want to have a hookah bar [0:13:22, 0:13:33]: You have to have uh an additional room or ancillary room where they can go and engage in that. Yes sir. And that's part of the legislation? Yes, that when we write the legislation that that that is what we will include as a requirement. [0:13:34, 0:13:41]: Okay. Yes, sir. I like the savage replace, but I don't like smoke. Yeah, I know. It's voluntary though. All right. [0:13:45, 0:13:47]: Board, any other questions? [0:13:48, 0:13:50]: Mr. Chairman. Sure. [0:13:50, 0:14:10]: I have a question for Mr. Edison. Mr. Doomas. Yes, sir. You use the word several in your narrative. You have received several requests. Yeah, from from uh business owners owners within who were owned restaurants. Would you would you characterize several as being less than ten or more than ten? [0:14:10, 0:14:13]: I'm not exactly sure because um [0:14:13, 0:14:20]: Uh it had to come from like once again, uh many uh business owners that that reside within the downtown. [0:14:21, 0:14:41]: district overla downtown overlay district and the Parkway mixed overlay district. They need they uh feel like they need to have a an additional revenue source and hookah and cigar smoking and stuff like that is very popular and it's allowed in a lot of different places. So they feel they need that additional revenue source. [0:14:42, 0:14:47]: I understand. Would you would you s characterize that you've gotten an avalanche of requests for this or [0:14:47, 0:15:07]: Yeah, um they've spoken to to a couple of council members and expressed their desire to have that right to do so. Um because businesses, there are other businesses outside of those particular overlay districts that are allowed to do so. So I just want to level the playing field a bit. [0:15:10, 0:15:12]: So if you're outside the overlay district. [0:15:12, 0:15:15]: And in a certain district you can have those type uses. [0:15:16, 0:15:18]: And the downtown district being a entertainment district. [0:15:19, 0:15:23]: I mean it would be kinda like natural to have that there. [0:15:26, 0:15:31]: Well I'm gonna go on record and oppose this and I'll tell you why. [0:15:32, 0:15:32]: Okay. [0:15:33, 0:15:46]: We just spent a significant amount of capital, human capital as well as economic capital, taxpayers dollars, to rewrite the UDC. [0:15:47, 0:16:02]: And we employed some brilliant minds to make that happen. And it went through a lot of approval processes, including the community. And the ink is barely dry on that document. [0:16:02, 0:16:04]: Yes. And [0:16:05, 0:16:16]: I'm a little apprehensive about amending it. Yes, sir. When it's bar the ink is barely dry on it. Yes, sir. It's a the people that are requesting this [0:16:18, 0:16:28]: had opportunity during the approved process to voice their concerns and obviously that did not happen. Uh in the [0:16:30, 0:16:36]: Parkway district there are about twenty two pro pro prohibited uses currently. [0:16:37, 0:16:40]: And in the downtown development district, I think there's about twelve. [0:16:42, 0:17:02]: Adult entertainment establishments, etc. etc. I won't list them all because I don't have it in front of me. Yes, sir. So that's my first reason for posing this. My second reason is more related to what Mr. Abdullah said. Yes. With the health concerns. Yes, uh and I [0:17:02, 0:17:15]: I know you use that the restaurant alcohol model t to to determine the amount of sales that should be derived from food. Yes sir. Um [0:17:15, 0:17:35]: I understand that the UDC, the the current UDC is approximately um 15 months old, but zoning ordinances, they are what we call living documents. So they're meant to be amended from time to time as as you implement them and you see that certain things aren't going the way you would like, so we have the right to amend it. [0:17:35, 0:17:55]: to uh so um and it will be amended several more times it's just it's the it's a living document so it's not perfect it's strictly a guide when you first get it and so as you go through several different scenarios or different situations and you find those situations not uh favorable or amenable to the city's policy. [0:17:54, 0:18:10]: policies, then you have the right to amend it to make it more favorable or more. So but and also uh as it relates to um the health um issue, I understand that that that tobacco is a um a big health risk, but uh it will strictly be voluntary. [0:18:15, 0:18:30]: I understand sir that this is not a perfect document. There's no document is. Everything is flexible and I'm not trying to be inflexible, but I think it would be premature to amend it just now for this purpose. [0:18:30, 0:18:31]: Okay. [0:18:33, 0:18:51]: I'm concerned about how the establishment's gonna provide this private area for people to engage in this activity. Uh uh you look at uh the size of the average establishment, I think it has a standing capacity, something like maybe two hundred and fifty people. [0:18:51, 0:19:08]: Well hookah lounges, they're they're required to have a um or cigar bars, they're required to have a certain type of ventilation system in place anyway. Yeah, well well you say you keep saying ventilation, but I'm talking about a separate room. That's what that's what I was I mean, that's something that we we're considering as part of the legislation. Yeah, well seeing the see [0:19:10, 0:19:23]: I think that needs to be set off someplace. I mean my personal opinion that needs to be set off. I think a lot of people wanna uh patronize restaurants, lounges, etc., but they don't wanna be subject to smoke. [0:19:25, 0:19:31]: Uh other uh carcinogenic activities. Yes, sir. And unless they have a private room [0:19:33, 0:19:38]: Even with the ventilation, it's gonna escape out. And so if you got a private room and ventilation, I can see that. [0:19:39, 0:19:59]: You know, but those those uh hookah lounges it it reduces the health hazard. Yes, sir. They will be only g on people will only uh frequent those establishments that are attracted to'em or engage in that activity. Regular I mean other patrons who don't like smoke or anything like that, they will go to the other restaurants in the city that does not engage in that. [0:19:59, 0:20:00]: So it's [0:20:00, 0:20:06]: So we say are are we saying we're gonna have a private room in ventilation? I mean that's a good [0:20:07, 0:20:09]: We got this activity going, you go down the street. [0:20:10, 0:20:26]: No, we're not saying that, uh, Chairman Abdullah. I'm just saying it it would it would strictly be a voluntary process. If you know a restaurant is engaging in hookah or cigar smoking or anything that that's your free right to not to go to that restaurant. You can patronize another restaurant. I I understand that. [0:20:26, 0:20:34]: Uh, but the point I'm trying to make is that I think this activity should be offset from the general population in that establishment. [0:20:35, 0:20:43]: Because there are going to be people that say for instance, you're in a restaurant. Yes, sir. I don't want my granddaughter, uh my daughter to be exposed to smoke. [0:20:44, 0:20:48]: You see what I mean? So if they got a private room offset and ventilation, fine. [0:20:50, 0:20:50]: You see me? [0:20:51, 0:20:52]: And so [0:20:53, 0:20:55]: My personal opinion is that [0:20:55, 0:20:59]: If they're gonna engage in that cabinet habit. And I understand the revenue aspect of it. I appreciate that. [0:21:00, 0:21:00]: Yeah. [0:21:01, 0:21:05]: I think it should be offset someplace. Okay. Uh yeah. [0:21:06, 0:21:15]: And if you can work that out fine, you know. Okay. Uh maybe we can table this to the next meeting so we can kinda work out some of the fine details and [0:21:15, 0:21:18]: Maybe we can get Mr. Doom's support. [0:21:18, 0:21:18]: Okay. [0:21:19, 0:21:25]: I'm not I'm uh l let me let me let me see on the record. I'm not opposed to it. Yes, sir. I just think there should be [0:21:25, 0:21:26]: Uh [0:21:27, 0:21:28]: An offset area. [0:21:29, 0:21:34]: Where people aren't exposed to uh smoke. I mean and I'm and I'm I'm contentious of [0:21:35, 0:21:51]: Cancer. And I know that smoke is one of the major carcinogens for for cancer. So you'd rather see some some regulations accompanying this pardon. You'd rather see some regulations accompanying this legislation before it moves forward. Yeah, I want I want you to here's what I want you to do. [0:21:51, 0:22:07]: I want you to tell the establishment, listen, if you're gonna engage in this activity or provide this, you need uh a separate room. It needs to be cut off from the regular room and you need to have ventilation so people aren't exposed to it. Okay, we can go back to the drawing board and come up with some guidelines. [0:22:07, 0:22:10]: Fine. Is that okay, Ballor? [0:22:10, 0:22:11]: Forced to [0:22:13, 0:22:14]: Yes, it's been advertised. [0:22:16, 0:22:16]: Yes. [0:22:32, 0:22:34]: look at um [0:22:34, 0:22:35]: The suggestions that you make. [0:22:47, 0:22:52]: Needs to be a public need to open a public hearing to have a give the public a chance to speak about this. [0:22:55, 0:22:57]: Soon is the uh citiest. [0:23:04, 0:23:05]: So [0:23:05, 0:23:25]: So uh I I think what council is saying that this has to go forward regardless of buttons. Yes, but they're but we w um but once we tell'em your recommendation, they'll have option to either send it back to refer it back to the planning commission or table it or m or whatever they decide to do. But they will have to refer it back to the planning commission. Okay. Yes, sir. No problem. [0:23:25, 0:23:33]: Um is that it? Yes, sir. That's all I got. May I speak on that? Go ahead. Chair. [0:23:34, 0:23:40]: Uh the only problem that I have is that if this goes to the council [0:23:41, 0:23:45]: They can bypass anything we say at the end of the day. Yes. [0:23:46, 0:23:47]: So that [0:23:47, 0:23:59]: needs to be known. Yes, we'll let that we make recommendations, but at the same time the council can do supersede anything we s settle on here. So this is not the last stop. [0:24:00, 0:24:01]: For the situation we're discussing. [0:24:02, 0:24:10]: Yes, sir. We'll and I will let them know that um that the Planning Commission is desirous to see some type of regulations or guideline governing [0:24:11, 0:24:18]: that use prior to adopting the uh legislation or the ordinance. They would rather for staff to come up with some rules [0:24:20, 0:24:25]: prior to adopting uh ordinance. So we'll let them know that's your desire. [0:24:25, 0:24:26]: So [0:24:26, 0:24:27]: Okay. [0:24:28, 0:24:35]: But even if you recommend approval or denial, the city council still can go whichever rate g go whichever route they choose to. [0:24:38, 0:24:39]: Okay. [0:24:40, 0:24:42]: Uh we'll open it up for public comment. [0:24:47, 0:24:51]: Anyone here who's from the public who has signed up that's opposed to this particular piece of legislation? [0:25:07, 0:25:27]: Uh thank you, Counsel. Uh my name is uh Jocelyn Williams and I'm speaking on the uh case number TX two oh two three oh one. Uh the reason I'm in opposition, uh I know there are a lot of bars that are around, and this is the first time I've heard or first time I know of any restaurant um that I take my family and uh [0:25:27, 0:25:47]: Um different I'm a teacher, so different children might go somewhere with me, um, like red lobster to eat. So I was trying to put in my mind how would smoking, because we can't smoke in any of the restaurants that I go to, so my opposition would be to have some kind of smoke in the area with fifty-one percent food. [0:25:47, 0:26:07]: And then the other forty-nine percent would be for the um hula bars and lounges. And I do understand that they do have to make money and bring in extra revenue, but my opposition would be to the um castrogen and the cancer in the air and how would they separate it without it coming through any vents or seeping through the um wall. [0:26:07, 0:26:18]: area. Um and thank you. My name is uh Jocelyn Williams, 190 Banks Drive, Stockbridge, Georgia, 30281, and I'm in the uh county of Henry. Thank you. [0:26:19, 0:26:24]: Thank you very much. I I think your your point has been already addressed by the board. [0:26:25, 0:26:28]: And uh we're concerned about that as well and uh [0:26:29, 0:26:34]: I'm sure uh the administrator will communicate that to the council. [0:26:35, 0:26:36]: Anyone else? [0:26:45, 0:27:02]: State your name. Address. My name is Sarah Bills. I live at 238 Northwind Drive in Stockbridge. And I've been informed by uh Smith Gamble and Russell that uh the [0:27:03, 0:27:10]: places that they're talking about are like five hundred feet from my home. So [0:27:10, 0:27:11]: Mm. [0:27:11, 0:27:12]: [1634.3, 1639.4]: This is a piece of text legislation. I don't I think you got uh zoning she's on [0:27:20, 0:27:23]: Excuse me, Ms. Yeah, so what are we talking about? [0:27:24, 0:27:28]: We were talking about a piece of text, let's say. We're not talking about the zoning matter yet. [0:27:29, 0:27:46]: This is we said this is strictly a piece of legislation that's being proposed by the city to amend the UDC to allow hoogah bars. So that's not what we're doing right now. Yeah, it has the same number. Is is that why I'm confused? [0:27:47, 0:27:50]: Okay. [0:27:50, 0:27:52]: About the speech. [0:27:54, 0:27:55]: I can just speak it now. [0:27:56, 0:27:59]: Just give us a few minutes and it'll come up on the next act. [0:28:00, 0:28:05]: Okay. The twenty twenty three oh one i isn't that what we say? [0:28:06, 0:28:08]: No, that's a text amendment, ma'am. [0:28:09, 0:28:20]: Okay. Uh Mr. Chairman, I just got a phone call from Vanessa Holiday who said that the microphone of Valerie Ross is not on and that nobody could hear her comments. [0:28:32, 0:28:35]: Anyone in support of it, just let this uh amendment. [0:28:39, 0:28:59]: Hearing none, uh the public comment is closed. That's not the way we do it. Uh the next item on the agenda is is uh item eight comprehensive plan amendment case chairman. Yeah, sure. Before we move, could we vote on that [0:28:59, 0:29:18]: that item before we move to the next item. No, we uh it's gonna be forwarded to the council. I don't think we would still need to make a vote, uh Chairman, on this item. All right. All right. All those in favor? Well first of all let me have a motion too on on the item number seven. [0:29:23, 0:29:24]: Mr. Dumas. [0:29:25, 0:29:27]: I move that we deny it. [0:29:29, 0:29:29]: Okay. [0:29:31, 0:29:37]: Uh mister Dumas has moved that the item number seven be denied. All those in favor let it be known by sign of aye. [0:29:38, 0:29:45]: But let's get a second before we vote. I second a second before we vote. Har Harrow seconded. You got that, Linda? [0:29:48, 0:29:49]: Thank you. Okay. [0:29:50, 0:29:57]: You second it? Yes, sir. I second. All those in favor, let it be known by the sign of aye. Aye. Aye. Opposed? [0:29:58, 0:30:12]: Hearing none, the ayes have it. The uh amendment is uh denied. Motion is denied. Uh item eight, comprehensive plan amendment case number CP 2022-4. [0:30:17, 0:30:18]: You literally do. [0:30:20, 0:30:21]: Yeah. [0:30:24, 0:30:44]: Comprehensive Plan Amendment, KCP twenty twenty-two oh four. Consideration of a request for a comprehensive plan amendment to assign the future land use designation of high density residential to certain property on Flippin' Road to allow for the construction of a mixed-use residential development, including commercial and office space. [0:30:44, 0:30:55]: The applicant is Vesta Residential Partners, uh care of Dennis J. Webb Jr. The property contains three parcels in lot thirty-eight of District twelve. [0:30:55, 0:31:08]: As are listed below with two hundred and seventy-six point nine one plus or minus total acres within the stock bridge city limits. Parcel number thirty oh thirty zero [0:31:10, 0:31:21]: Zero wero one zero zero four zero zero zero large parcel with two hundred and forty nine point nineteen plus or minus acres located between Flippin' Road and Interstate seventy five. [0:31:22, 0:31:23]: And six seventy five. [0:31:23, 0:31:43]: Parcel 03001003001, medium sized parcel with 24.97 acres located at 630 Flippin' Road, and parcel number 030-011010408, small parcel with two. [0:31:43, 0:31:46]: Four seven acres located at three hundred eighty four Flippin' Road. [0:31:49, 0:31:58]: Thank you, Mr. Chairman. My name is Gordon Linton, Planner One for the City of Stockbridge. I'm here to present uh CP twenty twenty two dash zero four. [0:32:02, 0:32:22]: The case facts: the applicant is VISTA Residential Partners, and the agent is Dennis J. Webb, Jr. of Smith Gramble and Russell LLP. And the applicant's request is to sign the future land use designation of high-density residential to allow for construction of a mixed-use development. The number of proposed [0:32:22, 0:32:30]: Units per acre is 4.84 units per acre, and the address of the property is 630 Flippin' Road. [0:32:30, 0:32:50]: 384 Flippin' Road and parcel number 03001004000. The number of acres is 276.91, and the project characteristics is mostly vacant with four single-family residences. The site is wooded with Rees Creek and its associated floodplains. [0:32:50, 0:32:58]: In the area. Currently, the city land use designation is medium density vertical mixed use, and the sign was posted on May 10th, 2023. [0:33:02, 0:33:22]: The City of Stockbridge comprehensive plan um amendment twenty eighteen to twenty thirty-eight um designates the subject property as medium density vertical mixed use. However, the current future land use is compatible with requested zoning to PUD, which is Plan Unit Development District. Therefore, the applicant is requesting a comprehensive [0:33:22, 0:33:32]: The plan amendment to change the future land the future land use designation from medium density fertile mixed use and to assign the future land use designation of high density residential. [0:33:36, 0:33:53]: As you can see, this is the future land use uh map for the property area with the star right here. As it's shown, vertical medium density, vertical mixed use. Um you have different areas, low density, vertical mixed use, medium density, and you have the area surrounding medium density, vertical mixed use. [0:33:58, 0:34:18]: The surrounding land use destination, you have properties to the north, which is Willow Springs, North Bridge Station Subdivision, Davidson Landing, and North Bridge Crossing as medium density residential, property to the south, which is Northwind, and Arbor, which is another subdivision. They're also designated as medium density residential. [0:34:18, 0:34:37]: vertical mixed use and the property to the east, which is Appleton, Glenn Attee, Grand Oaks, and Hillcrist Park, they're all subdivisions. They're medium density residential, high density residential, medium density vertical mixed use, and medium density residential, and properties to the west, which is I-675. [0:34:40, 0:34:57]: And this is the aerial photo. As you can see, this is the mixed use development right here. And you have Northbridge Station, you have Willow S William Willow Springs, Hillcrest Park, Appleton, Glen Addy, Grand Oaks, Arbor Cove, and Northwind. [0:35:01, 0:35:21]: This is the surrounding land use density. Um, as you can see, the estimated density per acre is eleven point six units per acre. Um, and it ranges from eleven point six to one point seven units per acre. And the Reese Creek uh mixed use development is around four point eight four units per acre. So based on that. [0:35:21, 0:35:27]: That density, that estimate, we believe that is consistent with the uh with the density of surrounding areas. [0:35:31, 0:35:51]: This is the site plan. This is uh pod, this is pod A, phase one, and phase two. Um, you have pod B, which is mostly uh senior living. Um pod C, you have townhomes. Um pod D, you have multifamily, and you have pod E, which is uh reach [0:35:51, 0:35:52]: [2157.4, 2177.4]: The the staff analysis, um, which is based on section nine point two seven of the unified development code. Consistency with the comprehensive plan. The requested comprehensive plan to assign the future land use designation to high density residential is necessary because the proposed density will be compatible with the required density for the requested [0:36:17, 0:36:37]: Land use designation. In addition, the current land use designation of medium density vertical mix use does not allow the development of townhomes. Furthermore, the proposed mixed use is consistent with the policy goals of the City of Stockbridge comprehensive plan that are listed as follows on page 35 and 35. [0:36:37, 0:36:39]: And thirty nine, which is on this table. [0:36:48, 0:37:08]: Staff analysis relation to the zoning of the property. The subject property requested zoning zoning district is compatible with the list of permitted uses that are found in the comprehensive plan, which includes the requested PUD, Planning Union Development District. Page 50 of the Unified Development Code states that a tenant of the PUD [0:37:08, 0:37:28]: Zoning district is to one, allow the development of balanced neighborhoods containing physical, economic, and social assets which are difficult to achieve through the traditional separation of use and density zones. Number two, provide an appropriate district for mixed-use developments. And three, to allow [0:37:28, 0:37:48]: Flexibility in design for environmentally challenged properties. Number three, suitability of the site's location. The requested future land use destination of high-density residential will be compatible with the other surrounding land use destinations that are either adjacent or nearby the subject. [0:37:48, 0:38:02]: property which includes the following subdivisions Glen Addy, which is high density residential, Grand Oaks, medium density vertical mixed use, Willow Springs, medium density residential, and North Bridge Station, which is medium density residential. [0:38:03, 0:38:23]: Maintaining the current land use designation. Due to the location of the subject property along a major flow which is Flippin Road, as well as the size of the property, it is unlikely that the type of permanent land uses that are intended for the medium density vertical mixed use will be allowed to be developed on this property. According to page forty three of the comprehensive plan, those uses will be developed. [0:38:23, 0:38:35]: will be two to three story buildings combining street level commercial retail office uses with second and third stories, accommodating offices, office or loft apartments and condominiums. [0:38:37, 0:38:57]: Staff recommendation. This staff report has demonstrated that the requested comprehensive plat amendment via CP twenty two twenty two dash oh four will be necessary and desirable for the subject property in conjunction with the requested rezoning of the property via RC twenty twenty two dash zero five to allow for the development [0:38:57, 0:39:03]: of a mixed use residential development. Therefore, the planning and zoning staff recommends approval. [0:39:09, 0:39:11]: Is the applicant present? Yes, sir. [0:39:19, 0:39:26]: Good evening, sir. Good evening. Uh my name is Din Webb, eleven oh five West Peace Street Street, Atlanta, Georgia, three oh three oh nine, here on behalf of [0:39:27, 0:39:30]: Mr. Residential Partners, let me see if I can get to my presentation here. There we go. [0:39:32, 0:39:37]: Yeah, I always bring paper copies'cause my technology technical skills are not that good. Into the mic? [0:39:37, 0:39:42]: If you don't mind, I'm not sure. [0:39:42, 0:39:46]: Um before I begin, let me introduce a couple folks who are here with me tonight. [0:39:47, 0:39:57]: Uh the fellow in the white shirt there is Chase Beasley. Uh he's here on behalf of re of Vista Residential Partners on the Zoom uh is a fellow named Michael Nayhardt who's who is also with Vista. [0:39:57, 0:40:10]: And behind Chase is Ken Wood and Daniel Hawker, who are with a company called Planners and Engineers Collaborative, uh, which uh is the project uh engineer for this. Sorry, I'm trying to shift some stuff around. [0:40:13, 0:40:14]: There you go. [0:40:15, 0:40:20]: All right, how's that? That's better. Better. All right, so uh [0:40:21, 0:40:41]: Just so you know, this particular matter is tied to the one behind it. So this is the comp plan request that's also associated with the zoning request. It's immediately follows this, and my comments really apply to both. Let me start with uh a little bit about the property. You see the site here outlined in yellow. As Gordon mentioned, we're on the west side of Flippin' Road. [0:40:41, 0:40:42]: South of Highway one thirty eight. [0:40:43, 0:40:46]: The property itself is about two hundred and eighty eкers. [0:40:46, 0:40:50]: And it was annexed into the city of Stockbridge in January of this year. [0:40:52, 0:41:11]: Uh you'll notice a cross-hatched area here. This is about 80 acres. This is not part of our application, but it's part of the story here because there is a story. Uh back in 2019, Henry County zoned the 280 acres that we're here to talk about tonight, as well as the 80 acres that I mentioned. [0:41:11, 0:41:13]: for a mixed use development um [0:41:14, 0:41:22]: It was a large mixed-use development, 1,643 residential units, which included apartments, townhomes, senior living, duplexes, and single-family detached. [0:41:22, 0:41:26]: And there were a variety of non residential uses, including three hotels. [0:41:27, 0:41:37]: fourteen office buildings and three hundred thousand square feet of restaurant retail space. That project, like our own, also was reviewed as a development of regional impact by the Atlanta Regional Commission. [0:41:38, 0:41:46]: The property that Vista owns is effectively the residential component of the Henry County project that was approved four years ago. [0:41:46, 0:41:50]: Uh the plan that we're here to talk about tonight is similar. [0:41:50, 0:42:10]: To what Henry County approved and entitled, but a little bit less intense. I think one of the first things you'll notice is that there's been a real emphasis on creating some green space on this property. We've actually preserved almost 72 acres or over 25% of the site as green space. And that green space includes an extension of the walking trail that basically terminates on the [0:42:10, 0:42:14]: the east side of Flippin' uh Road across from our property. [0:42:14, 0:42:28]: The other way in which this development is less intense is the number of units. We've got about twenty percent less units than what Henry County approved four years ago. There are 1,347 total, and that includes multifamily townhomes, senior living, and single family detached. [0:42:29, 0:42:46]: From the beginning we've been really uh or Ken's team really has been thoughtful in the orientation of the uh product on this site. The single family detached is predominantly around the north and west perimeter where our property abuts single family detached. So we've got the same product on both sides of the property line. [0:42:47, 0:42:51]: The multifamily uh is concentrated in the center because there's a little bit more activity there. [0:42:52, 0:43:12]: Um and the townhomes are here on the southwest corner adjacent to six seventy five. So we tried to to match sort of intensity to intensity with the orientation. And as Gordon mentioned, uh really at the request of staff, we also included uh some other uses. We didn't really have uh the office use or the commercial component in our original concept when we were talking and [0:43:12, 0:43:19]: And meeting with ARC, there was a request to add that. So we've added 40,000 square feet of office here on the south end. [0:43:19, 0:43:31]: as well as a small uh commercial component here on Flippin. And the idea here here, and it's hard to see because this is a huge piece of property uh represented on an eight and a half by eleven uh size piece of uh paper. [0:43:32, 0:43:36]: But the idea is that there's a parking lot that ties into the trailhead on the other side of Flippin' Road. [0:43:37, 0:43:44]: And folks can park there and access the trail at that point and either go east or west because again we'll have an extension on our site. [0:43:44, 0:44:04]: But there's also area for two commercial spaces there. So as the trailhead continues to become more popular, as this development becomes a reality, there's an opportunity to put a little coffee shop there or a bike repair shop or something that would really serve the trail. That's the thinking here. And I think that ultimately was a good idea. There's not a great opportunity for a lot of commercial on that portion of Flippin' Road. [0:44:04, 0:44:12]: Because there's a lot of topography there. Most of the site is actually below grade, but that's an area in which we think commercial would work. And I thought that was a good idea to add it. [0:44:13, 0:44:18]: In terms of access, we've got uh three access points on flipping road here. [0:44:18, 0:44:25]: on the north side, here on the south side, and again a driveway for the smaller commercial commercial component that I mentioned. And I want to [0:44:26, 0:44:34]: Kind of highlight another feature we've added here on the backside. So there's a this drivetime industrial development to our north. [0:44:34, 0:44:35]: Um and uh [0:44:36, 0:44:39]: It seems strange to us at least that [0:44:39, 0:44:44]: to access that property you really kinda drive through residential areas. That's a little bit unique. [0:44:44, 0:44:50]: So we've actually created a way for those folks to get out so the drivetime folks can actually come out of [0:44:51, 0:45:01]: through their parking lot here and ac uh uh uh come through the sort of the the northwest corner of our site and tie into the eighty acres to the north. Now there there are some things that have to fall into place [0:45:02, 0:45:06]: You know, obviously the eighty acres to the north has to be developed. There has to be a road network that goes through. [0:45:06, 0:45:22]: But we've at least taken step one to create a way for the d the employees at drive time to come out of their property and avoid the residential area. It's not our problem. We didn't have anything to do with that development. We didn't create this, but as we were talking about things that seemed like a good idea and we had the land to do it, so that's something we've added to [0:45:22, 0:45:23]: The programme here. [0:45:25, 0:45:35]: Just so you know, this is a phase development. This is not going to come in overnight. This is really a sort of a realistically a seven to eight year build out. Uh in terms of phasing, the idea is to start here. [0:45:36, 0:45:41]: With pod A, the multifamily component, uh, there's a a second phase in pod A here. [0:45:42, 0:45:43]: Uh [0:45:43, 0:45:54]: The expectation is that the single family detached on the northern side of the site will be really f the second phase and I suspect that the single family will be built in phases as well. Um [0:45:55, 0:46:03]: The townhomes will be the third phase. The senior component and the office component will be uh effectively the fourth phase. [0:46:03, 0:46:20]: And this commercial piece on flipping that I talked about will really come when the when you've got the traffic to support it, right? To have that kind of uh uh use on a a trail, you've got to have people who will stop and buy a cup of coffee. So once the the intensity gets to a point to support it, that will come in. [0:46:22, 0:46:26]: I've got some individual pod plants here. I'm happy to go through these, but I just [0:46:27, 0:46:43]: put them in because they show you a little bit more of a uh a a closer representation of the detail in each of the different areas of the site. This is these are the pod A uh components that I've referred to. This is effectively pod B, which again is the senior and the office component. [0:46:45, 0:46:50]: These this is pod C, the townhome piece, and pod D, which is the single family detached. [0:46:51, 0:47:08]: So one part of the story that didn't come up earlier is that uh like I said, this property was annexed into the city in January of of twenty twenty three. It came in without any zoning designation. So it it came in unzoned and on May eighth of twenty twenty-three the city zoned this to PUD. [0:47:08, 0:47:28]: So we already actually have the zoning we need for this development. But if you know the PUD code, it also requires a regulating plan to go along with it. And this development was not adopted with a regulating plan, and that's really what we're here to do on the zoning side. So we've got a development plan to marry with the PUD zoning on this site, and that's our request, as well, of course, as the [0:47:28, 0:47:31]: Complet amendment that was just discussed. [0:47:34, 0:47:45]: Uh I appreciate certainly working with staff. We've had a bunch of meetings uh we've been d at this for longer than you can imagine. You know, we we're here for the first time tonight, but we've been working on this thing with Stockbridge really for about a year. [0:47:45, 0:47:49]: Um so we've worked with Breco, we've worked with Ryan. [0:47:49, 0:47:54]: Uh and I appreciate Gordon's work on the uh comp plant amendment. Uh they've been a great help here. [0:47:55, 0:48:14]: Um they are recommending approval as you heard for the comp plan amendment. They're also recommending approval for the zoning, uh subject to some ki conditions. And we're generally okay with those conditions. We saw them for the first time yesterday. I would like to wordsmith a few a little bit differently, but you know, in turn in concept, we're we agree with all of them. And I think between now and the city council hearing. [0:48:14, 0:48:18]: We'll have some talks with staff and try and uh you know maybe uh [0:48:19, 0:48:21]: S say things a little bit differently. So [0:48:22, 0:48:42]: I think I'm gonna stop there. I've said a lot. Uh I'll happy to answer any questions you have. I'll reserve my time and we'd ask for your recommendation of approval on the comp plan request as well as the rebound. Okay, question for you. Yes, sir. Uh and um I'm interested in this. Uh particularly have you consulted the community? Because I'm sure they they want to get rid of drive time coming through the community. So we [0:48:42, 0:48:50]: We've we to some extent we have. Uh uh uh uh this lady mentioned she got a letter from me. So she's uh I I've sent a letter out. [0:48:51, 0:49:11]: To everybody within a certain radius of the property. I think we sent about a hundred letters out inviting them to a meeting. So we had a community meeting. Um there was not great attendance, I'll admit that, but we did have one and offered to uh answer questions. I've gotten a few phone calls from folks who um you know received my letter. I think the reality is for [0:49:10, 0:49:26]: many people in the area they know this property's already been entitled, right? I mean I think I my guess is, and this is just a guess on my part, four years ago somebody came through and proposed something similar to what we're doing but a lot more intense and I you know, I suspect people were expecting that. They've been waiting for it to happen. [0:49:27, 0:49:34]: And uh you know, that may be why there was less interest in what we're trying to do tonight. But yes, we we have reached out to the community, we offered to meet and we held a meeting. [0:49:35, 0:49:35]: Okay. [0:49:40, 0:49:57]: Mr. Tividor. Mr. Thivodeau. Okay. Uh have you done any traffic studies? Yes, sir. So uh we have. Um as I mentioned, uh we have been reviewed as a development of regional impact. So if your development crosses a third a certain threshold. [0:49:57, 0:50:17]: You go to a higher level of review above the city level. It's a review conducted by the Atlanta Regional Commission and the Georgia Regional Transportation Authority. So the minute we filed our rezoning application, our project was kicked to the regional review. And as part of that, we did a traffic study in conjunction with the Georgia Regional Transportation Authority. So we sit down with the transportation [0:50:17, 0:50:19]: Experts in Metro Atlanta. [0:50:20, 0:50:40]: They define the scope of the traffic study that we have to perform. We did it, we submit it to them. They make recommendations for some changes that need to occur on the roadway network. Those are actually addressed in our zoning conditions. Uh when we concluded the the DRI process, uh the ARC notice of decision included some conditions. [0:50:39, 0:50:46]: conditions that require some improvements on the roadways, and those conditions have been adopted in our with our zoning. [0:50:47, 0:51:07]: Uh one other thing. What what was your response for the meeting that you had with the community? What what was the information that was given to you by the community as far as the do's, the don'ts, and what they want? What what kind of information did you receive from from the community on that? [0:51:08, 0:51:28]: I didn't get any do's and don'ts. It was more of a what's happening here kind of thing. There wasn't a I don't like this or I don't like that, or would you think about changing this or that? I actually use these exact same slides by the way. So the ones I showed you are the same ones we used at the community meeting. It was more of a, you know, what's the plan? You know, what's the build-out time, that kind of thing. How what what's been the process so far? [0:51:28, 0:51:30]: Um you know uh [0:51:30, 0:51:35]: The folks I've talked to, and again, that's not a lot, but the folks that I've talked to have really been relatively positive about this. [0:51:41, 0:52:01]: Okay. Uh we'll open it up for public comments. Mr. Chairman, before we do that, can I ask just one question? Uh you mentioned some road improvements that were required under the DR uh the DRI, am I saying that right? Yes. Or the uh Greta. [0:52:01, 0:52:21]: uh analysis. Would you elaborate a little more on those road improvements that would were required that you've adopted in this plan? Right. So there are flipping road. Right. So there are really two two types of recommendations made uh in the the ARC. [0:52:21, 0:52:37]: notice of decision. The first are traffic improvements that are project specific, things we have to are are we are required to do as part of the project. There are also some system improvements that the the city is supposed to be doing. So we we look beyond our project the the the the network that was studied [0:52:38, 0:52:51]: as part of the DRI transportation study was more significant than just our site. So the primary uh change was at the addition of a turn lane on Flippin' Road as well as a deceleration lane into our property. [0:52:51, 0:53:09]: There were some other changes on the radius of the curb cuts and things like that that were a little more tactical, but those are the main the primary changes on Flippin' Road. Other recommendations were made up at the uh intersection of Flippin and was it 138, North Henry Boulevard. Um, but those are what are characterized as system improvements. [0:53:12, 0:53:27]: I have what question this day planchon. Um at this stage your request is m uh merely to modify the land use plan to accept this type of development, right? We haven't we're not into any nuts and bolts yet of the actual development. [0:53:27, 0:53:42]: Well so we we have two requests I mean we'll get there, but right now this request is just to modify the land use plan, is that correct? So so the agenda item right now, n item number two on the agenda is is the comp plan amendment. Item number three is our rezoning. But uh [0:53:42, 0:54:01]: They're sort of part and parcel, to be honest. You you have to take the comp plan first, technically. But the idea uh I mean there's not a whole lot left to say in terms of nuts and bolts. Um, but again, you know, uh although we have a rezoning application, we are already zoned to the district we need. We just need a plan approved. Yep. [0:54:08, 0:54:15]: Karen, could everyone please speak a little bit louder? Uh speak directly into the microphone, please. I some have inquired about that. [0:54:17, 0:54:18]: Is there a way to turn this up? [0:54:20, 0:54:22]: I think I'll turn it off. [0:54:26, 0:54:27]: I'm not sure, but uh [0:54:29, 0:54:30]: Pardon me? [0:54:33, 0:54:44]: Please check in to see if you can turn it up. In in the interim, um, if I may, Chairman Abdullah, just anyone who's speaking, please speak directly into the mic as you're speaking so that we can capture it for the record. [0:54:46, 0:54:47]: Okay. [0:54:49, 0:54:52]: Uh I think at this point we opened up a public comment. [0:54:55, 0:55:06]: All those uh who uh in favor of uh this particular comprehensive amendment, uh you can approach the uh podium, give us your name, address. [0:55:11, 0:55:13]: Those o opposed to it. [0:55:15, 0:55:17]: Would you come forward, ma'am? [0:55:29, 0:55:31]: Kind of give us your name, your address. [0:55:32, 0:55:33]: Again. [0:55:33, 0:55:46]: I'm uh Sarah Bills. I live at 238 Northwind Drive in Stockbridge in the um county of Henry. Um [0:55:48, 0:55:51]: Could you repeat that please? Your name and address? [0:55:51, 0:55:52]: My name is Sarah. [0:55:54, 0:55:55]: Billlops. [0:55:56, 0:55:59]: two hundred thirty eight Northwind Drive. [0:56:00, 0:56:02]: Here in Stockbridge. [0:56:03, 0:56:07]: and uh county of Henry. Um [0:56:08, 0:56:10]: As I'm listening, I'm I'm not uh [0:56:12, 0:56:14]: At this point, really sure. [0:56:14, 0:56:15]: Um [0:56:16, 0:56:36]: What I had come in uh to find out about, I'm pretty much finding that there's not a an awful lot that uh can be done. It's it's been a a lot of uh decisions made already. But um I'm I'm still going to say this that uh we are a residential area. [0:56:36, 0:56:37]: There we are. [0:56:38, 0:56:58]: And when I bought, I didn't buy for a high density area. Um and I'm I've got some feelings about that. I don't um no, I know it's good for the tax base and stuff like that, uh, but I'm concerned about traffic. Um [0:56:58, 0:57:18]: And I think I heard you say that traffic is gonna have to come through the residential areas for people to uh be able to um move back and forth. Um that is a concern because traffic is already difficult on flipping. Um [0:57:18, 0:57:38]: But um I do want to get it on the record that as a resident that I am concerned about this. Um I I don't know how anybody else feels about this, but we were not involved in any of this uh discussion. [0:57:38, 0:57:40]: discussion, decision making and [0:57:41, 0:57:49]: You know, I understand that, you know, you all are taking care of the business, but you know, for me, this is where I live. [0:57:50, 0:58:05]: So I'm very concerned about which way this is going to go. And um maybe we can't do anything at all about it. Um and I've seen that many times, but [0:58:05, 0:58:17]: Um at the same time I do want to express my concerns about um transportation, about safety, um [0:58:18, 0:58:27]: There's so many areas, but I just wanted to get it on the record because uh uh are you adjacent to Flipping Road or close by? [0:58:27, 0:58:47]: Yeah, I'm I'm right off of flipping on North Wind. It's right there. And according to the letter that I received, whatever buildings they're doing. Now you had a zoom yesterday, but we had very late notice of this zoom, and I had something else, so it wasn't possible to [0:58:47, 0:59:07]: Participate in the Zoom. But it was nice of you to let us know anyway. But my understanding is I'm receiving this letter as you own property within 500 feet of these parcels. So you know I'm not making it up. I I have some concerns here. [0:59:07, 0:59:27]: And um I just wish we had had more input um so that we might feel a little bit Well I'm gonna say this to you. Generally when a development comes into place like this, there's going to be a buffer zone to a buffer to separate uh development from your residential area. [0:59:27, 0:59:41]: Uh maybe he can speak to that, maybe the applicant can speak to that, but as a general rule, as a buffer, so that you don't have that uh intrusion uh onto a residential area. [0:59:42, 0:59:45]: Yeah, I hear what you're saying. I but I also heard what he said. [0:59:46, 0:59:48]: And uh you know [0:59:49, 0:59:55]: They they're both um, I'm sure, based upon situations. Um [0:59:55, 1:00:15]: applicable but um in this case he actually said traffic is gonna have to come through the communities and I mean that that needs to be clarified for the people who live in the communities. I want to know am I gonna open my door and uh see all kinds of traffic [1:00:15, 1:00:19]: moving through and um you know [1:00:19, 1:00:20]: That's [1:00:21, 1:00:22]: So [1:00:22, 1:00:22]: You know. [1:00:23, 1:00:40]: I don't know how much we can do, but um I would sure love to hear uh how they plan to do it and certainly I'd be very interested in the buffer. Okay. You know? Thank you. Sir, would you kinda address that for us please? [1:00:56, 1:00:59]: Fill out a sheet with your name and address. [1:01:01, 1:01:03]: It's up there. Okay. [1:01:05, 1:01:25]: So uh uh I think the ladies' home is right around here. Can you guys see my cursor? Yes. All right. So we do have uh a a minimum 50-foot buffer along this eastern property line, as well as you can see, a pretty significant amount of green space at the tip of this particular uh uh [1:01:25, 1:01:31]: Uh uh this is the town home piece uh adjacent to her property. So she will be well buffered there. Um [1:01:34, 1:01:36]: Ma'am, can you see that what he's pointing out? [1:01:37, 1:01:44]: I've got a handout that I can Okay. No, I'm just saying I'm asking her, can she see it on the monitor here? Where he's pointing out. [1:01:48, 1:01:54]: Yeah, but what what he's saying is there's a a green space and a minimum fifty foot buffer. [1:01:55, 1:01:57]: So it there will not be [1:01:57, 1:02:02]: any direct intrusion on your property. You have that uh that zone [1:02:02, 1:02:04]: To separate you from the development. [1:02:06, 1:02:11]: And if the zoning's approved it'll be zoned subject to a site plan, so that that [1:02:11, 1:02:21]: buffer will be a a a condition of law, really. I mean the a zoning ordinance is a law in and of itself, so it will be illegal not to build the buffer. So uh she uh she and everybody else will be protected in that regard. [1:02:22, 1:02:33]: The one other thing I wanted to clarify that she she said about n uh traffic come through the neighborhoods. That that's not the point I was trying to make. The only driveways we have are on flipping. We're not going through her neighborhood or anybody else's neighborhood. We don't connect. [1:02:34, 1:02:50]: The point I was trying to make about uh traffic coming through the neighborhoods is that drive time is coming through the neighborhoods now, which does not make a lot of sense to me. You've got an industrial use that is using residential roads, and we've got an opportunity to try and fix that. So uh [1:02:50, 1:02:55]: That's the only point I was trying to make about uh, you know, coming through the [1:02:55, 1:03:11]: the neighborhoods. We're not. But drive time is right now and again we've got a a one way driveway that effectively comes out of the back of their parking lot and connects that eighty acres to the north. And that was the point I was making when I asked you had you consulted with the community because I thought that would be very attractive to them the mere fact that drive time we no longer use [1:03:12, 1:03:16]: uh the community as a thoroughfare. I would think so too. Yeah, so [1:03:16, 1:03:19]: One other thing coming back to your point, sir. Uh [1:03:20, 1:03:31]: My engineer reminded me that one other traffic improvement is a traffic signal at our southern driveway. So we'll be adding a signal at that location, which should improve a lot of things on our site and actually on Flippin' Road. [1:03:32, 1:03:34]: Can I also ask that I have your attention [1:03:35, 1:03:38]: Why a one way uh stab? [1:03:39, 1:03:41]: Up near the drive time. [1:03:41, 1:04:01]: Well, we figured they didn't want our traffic coming through uh the neighborhood or through the drivettime property. It's it's you know, w we would have I guess the ability to come out and access the eighty acres, but we're not intending that to for any of our folks to take a right and cut up through the drivetime parking lot. We're we're trying to fix that problem and we don't want to add to it. Does that make sense? [1:04:04, 1:04:21]: Well it it it it does from your perspective, but from the perspective of people that live in the subdivision just to the north of Drive Time, because the only exit now is to the north and it goes into the subdivision. That's exactly right. You're exactly right. [1:04:23, 1:04:30]: A one way stub would not prevent truck traffic because what you have is [1:04:31, 1:04:33]: Tow trucks, hauling cars. [1:04:34, 1:04:52]: through the residential area to get into drivettime. Now, admittedly, you said it. It's not your problem. You didn't create it. I didn't either. I don't know how it happened, but I would be supportive of anything that could bring some relief to those folks. [1:04:52, 1:04:58]: So my point about one way is that it's it's it's and maybe I said that incorrectly. [1:04:59, 1:05:05]: L let me let Ken talk. K Ken is the the the genius behind the stub roads. Let me ask him to address that bit. [1:05:06, 1:05:26]: Uh Kenneth Wood 350 Research Court. So just to make just so we're so we're clear, so this the idea of the stub is to provide two-way access from drive time into the 80 acres for access there. The only one way item that that we're really speaking of is is our residents could go through a gate. [1:05:26, 1:05:46]: and go up into the 80 acres once that is constructed, but drive time could not come down through another residential area like ours. But the the road we're talking about that we would construct the to provide that access is two way. I gotcha. It is two way. I gotcha. Thank you. That's what I in Release. [1:05:46, 1:05:48]: Let me ask a let me ask a question. [1:05:48, 1:06:08]: Mr. Chairman, are you concerned at all that this development will not be visible from Flippin' Road? So any of the commercial restaurants entities will nobody will know they're there because it's up behind a hill? So that's an excellent point, right? Uh and and that's one reason. [1:06:08, 1:06:15]: Reason why the only commercial you see on this site is here. It's sort of the high point along flipping. You see where my cursor is? [1:06:16, 1:06:36]: And and what we're talking about really in a a full scale restaurant, it's really a an amenity for the trail. That's what we're thinking about. You know, if you're look, you go down to the belt line, right? And you s you you walk the belt line, they've got an ice cream shop, they've got a bike repair store, they've got, you know, a coffee shop, that kind of things. Sort of somebody something somebody can walk into as they're, you know, making [1:06:36, 1:06:55]: They're away from point A to point B. But that's why we don't have more commercial. So what you see down here is actually just office space on this on the south side. If visibility were better, we probably could do something a little bit more commercial and flipping, but it's not. So act, you know, commercial is all about access and visibility, and we don't have the visibility other than sort of right here. [1:06:57, 1:07:00]: Yep. And all that office space, what kind of traffic you anticipate that? [1:07:01, 1:07:15]: Pardon me? The office space, how much traffic do you anticipate that bringing in as far as not just the employees coming to work every day, but the type of businesses they'll be running out of there and the traffic that's gonna be added to that also? [1:07:15, 1:07:25]: Yeah. I don't know the numbers off the top of my head, but that was part of our traffic study. So the traffic engineer considered the potential or the traffic would that would be generated by forty thousand square feet of office. [1:07:25, 1:07:41]: So it was you know, I I don't remember the numbers, uh, but I but I know it was part of our analysis and it was part of the information we provided to to Greta and it was part of the information Greta relied on to require us to do some things on the roadways. As we move further down the road with this, are you gonna provide that traffic study to us? [1:07:43, 1:08:03]: Yeah. Pardon me? I said as we move further down the road with this, are you going to provide that traffic study to us? Oh yeah, you ha it's it's a part of the w it's been submitted to the city. It's part of the public record. Ken Ken mentioned that the the office is really contemplated as general office, sort of like professional, your doctor, your dentist, that kind of thing, smaller scale. Not uh we're not talking about [1:08:03, 1:08:15]: Cisco or Apple or a major employee coming in. It's really more of a, you know industrial big truck tracking. Oh no, no, no, no. There'll be no industrial on this product. Okay. [1:08:18, 1:08:21]: hearing. Might there be other citizens here who wish to speak? [1:08:26, 1:08:36]: Can I just ask the question before you sit? You mentioned a traffic light at the southern entrance. Yes, sir. That's in close proximity to the [1:08:37, 1:08:40]: trailhead across the street. Am I correct? [1:08:41, 1:08:43]: Yeah, do you know the distance? [1:08:43, 1:09:03]: And so it it is and so the idea of the traffic signal there, we're originally looking at like a hawk signal to get people from one side of Reeves Creek to the other to extend the trail. That's where I'm going with the well now we're since we're now gonna be a lighted intersection, you know, you can push the button, the light will physically stop traffic and then you'll be able to cross. [1:09:03, 1:09:14]: So I could go to the bike shop and then cross the street and then go east and go. And then go east. Yes. Thank you. [1:09:18, 1:09:20]: Think we have public comment back then, sir? [1:09:21, 1:09:23]: Come to the mic proceed, mic. [1:09:30, 1:09:45]: Evening council. Uh my name is John Cloudus. I live at one fifteen Mimosa Drive, uh Stockbridge. I had to apologize for my nervousness. I wasn't really planning on speaking tonight, but after seeing everything and living on Flippin' Road for ten years, the idea of this is kinda [1:09:47, 1:10:05]: It's scary. I don't know. I live right I don't know if you know where Mimosa Drive is, but I live almost directly across the street from Northbridge Station. And on a Friday afternoon at three thirty, Flippin's dead stopped because people use Flippin' as a through Fry seventy five. [1:10:05, 1:10:25]: I can't imagine what 1400 housing units in that area of Flippin is gonna do for the congestion that already exists at the intersection of Flippin and North Henry Boulevard. Um I'd also like to add, we didn't receive a letter. Um I don't know how how wide of a radius they sent letters out. [1:10:25, 1:10:45]: To people who are going to be near this, but I can throw a rocket at this property from my house. Um, I'm all for building Stockbridge up. It's been awesome seeing all the changes that have happened over the past couple years with the downtown area, with people renovating and revitalizing their homes. And I'd love to see that continuing. My wife and I take our dog down. [1:10:45, 1:10:53]: Down Reeves Creek Trail once, twice a week. We love it. The idea of it being longer is great, but the idea of it being a belt line. [1:10:53, 1:10:54]: Or something similar to that. [1:10:55, 1:10:56]: That's not a reality. [1:10:57, 1:10:58]: I know they're trying to sell something that [1:10:59, 1:11:00]: It would be great, but [1:11:01, 1:11:02]: Uh there's no [1:11:03, 1:11:10]: I guess the other thing that that bothers my my wife and I, um, she's from up north. Everybody walks everywhere. She's from Connecticut. [1:11:11, 1:11:14]: She tried to ride her bike down flipping road one time when she first moved here. [1:11:15, 1:11:17]: She got pretty scared, turned around and came home. [1:11:17, 1:11:28]: There are constant foot traffic on Flippin. I don't know how we're gonna have sixteen hundred or fourteen hundred housing units with no sidewalk on Flippin' Road. How are people gonna get to Reeves Creek Trail? [1:11:28, 1:11:45]: if they're going to it from even if they're coming from their apartment. I mean, it's not really a row for pedestrians. As much as I love Reese Creek Trail. It's just I I wouldn't walk down flipping. It's scary. It's scary to drive down flipping. Especially, you know, coming up to the uh [1:11:45, 1:12:03]: right right where the old city of Stockbridge city uh city limit line used to be. It goes from forty five to thirty five. I think I'm the only planet person on the planet who actually slows down to thirty five. We almost get rear ended almost time we turn almost every time we turn into our into our driveway. I can't imagine what more traffic's gonna do for that. And I know [1:12:04, 1:12:05]: They're uh [1:12:06, 1:12:13]: There's separate issues, there's zoning and then there's plans that have to be approved, but I don't know. I wouldn't feel right if I didn't say something. So [1:12:17, 1:12:19]: I have a question for you. Yes, sir. [1:12:20, 1:12:22]: What would you like to see developed on that property? [1:12:22, 1:12:26]: Oh man, I given all the considerations that you just articulated. [1:12:26, 1:12:27]: Um [1:12:27, 1:12:35]: I don't have a problem with there being housing. I don't have a problem with there being high density housing. I have a problem with there being high density housing there without the infrastructure. [1:12:36, 1:12:41]: That's my that's my concern. So your concern is basically in infrastructure related. [1:12:41, 1:13:01]: Yeah, Flippin' Road. I mean I don't know if you've ever driven down Flippin' Road at Oh I'd go all the time. It's terrible. I mean it's it I love where we live. We love our house, we love our neighbors. I'm actually so of our other neighbors wanna come, but they had to work. Um our our neighbor who lives at the front of the street, he has a wreck in his in his driveway once a month. [1:13:01, 1:13:06]: Because people fly up flipping, heading to the wards that [1:13:06, 1:13:07]: That light. [1:13:07, 1:13:14]: Or they don't slow down and they have to swerve off. He th his uh yard has a little ditch in it. And now I'm just rambling. I'm so sorry. [1:13:14, 1:13:23]: You ask me and well. Um again, I love the idea of re of uh the trail being extended. That's awesome. Um [1:13:23, 1:13:26]: I don't know what there could be you know. [1:13:26, 1:13:46]: community farm. I mean there's that could be a bigger park. I mean there's all kinds of things you could do with nearly 300 acres of woodland that's been there for you know 150 years. It's been there a long time. I mean it's been there longer than that, but developed with houses around it for a long time. So again, I don't have a problem with there being housing [1:13:46, 1:13:48]: I mean look at uh [1:13:49, 1:14:01]: what they did with uh the farm, uh Broder farm. I mean that's been a great development. I mean it's made Kroger a little bit more busy and has made Flippin back up more on that end of Flippin'. But I mean there's people getting housing. I mean [1:14:02, 1:14:06]: I'm in real estate. It's the the housing market's expensive. So having [1:14:07, 1:14:27]: Having housing available is a good thing. I am kind of curious because of the things that I've looked at about the developer for this, they mainly deal in apartments. So that the thing that I'm nervous about is this plan looks great if it comes to fruition, but what's to stop them from building the apartments in pod A and B and then not continuing out the [1:14:26, 1:14:28]: Yeah. [1:14:28, 1:14:37]: If that makes sense. That's always a risk. Right. I mean I don't I don't have any control of that. I mean it's n neither do they. I mean they couldn't go belly up and what happens. So [1:14:38, 1:14:39]: I don't know. It's just [1:14:40, 1:14:44]: We've been watching that property for the past five years, wondering what was gonna happen with it. And [1:14:45, 1:14:47]: You know, and again, we didn't get a letter. I just happened to [1:14:48, 1:14:59]: happened to see the zoning thing and looked at the tax record and saw that it, you know, had changed ownership. So I was under the impression it was still zoned agriculture.'Cause that's what it says I think on the tax records. So [1:15:01, 1:15:06]: Think that's it. Unless you guys have any more questions for me. No, I'm done. Thank you. Okay. [1:15:06, 1:15:08]: Thank you guys so much for your time. [1:15:09, 1:15:11]: Please fill out a sheet on that clipboard there. [1:15:11, 1:15:12]: Anyone else? [1:15:14, 1:15:16]: We do probes a podium, ma'am. [1:15:22, 1:15:25]: A sheet on this clipboard over here at the front. [1:15:25, 1:15:40]: Uh good evening. Um once again. Thank you, Council. Jocelyn Williams, one ninety Banks Drive, Stockbridge, Georgia, three oh two eight one, Henry County. Uh I bought my house in nineteen ninety two and this particular um [1:15:42, 1:15:55]: project that he's speaking of was brought before the community a couple of years ago but for some reason I never heard of it being changed into something else and it's uh probably my fault but um [1:15:56, 1:15:58]: I would like to [1:15:58, 1:16:07]: say that they can build, they have a right to build and th all the provisions for it is gorgeous. My concern is infrastructure. [1:16:07, 1:16:27]: Featherman Road, I am a teacher. I get up at four o'clock in the morning so that I can be to work at 710. If I don't leave by 5:30, I won't I'll be late every day. And then I come home late at night and have to get behind the buses that come to Henry County. Everything in Henry County is excellent. My only concern is for the [1:16:27, 1:16:34]: developers to talk to the community. I am very avid in the community next door. I don't hear [1:16:35, 1:16:55]: of them coming to meet and if they are meeting, I don't I just need to put my name on their roster so that I can inform the community because my neighbors always ask me what's going on and they couldn't be here. The traffic and the infrastructure is our mantra, our concern. They're building, building, building, but no one is [1:16:54, 1:16:57]: doing anything with the two lane structure. [1:16:58, 1:17:18]: Um that we're bringing into the community. Popeyes, fried chicken, beautiful facility. Once again, congestion. Fip and road infrastructure. There's nothing in 2024 that I see being done. If we could make a condition with the [1:17:17, 1:17:19]: Planning if they could [1:17:20, 1:17:35]: come and show a community meeting, ask us. I will go online and ask people to come. I'm sure they would like to ask questions like we're doing if a condition I I know I have no power, my request that the [1:17:35, 1:17:55]: Developer of this beautiful property, come and talk to us. Let us ask you questions. Show us in in a paper form what you are planning. How soon are you coming? How soon are you building? When will Flippin' Road get wider? What will you do different with that? We just wanted some questions. And I'm just so grateful that [1:17:55, 1:18:06]: that we're all working together because this is a wonderful county with a lot of beautiful land and we need them and they need us and I'm just so thankful to speak. Thank you. You're welcome. [1:18:08, 1:18:09]: Anyone else? [1:18:13, 1:18:13]: So [1:18:17, 1:18:20]: Chairman, I'm sorry, have we closed the public hearing session? [1:18:20, 1:18:25]: He has a comment. Okay, but we'll need to close it in order for this conversation. [1:18:25, 1:18:25]: Go ahead. [1:18:27, 1:18:31]: Uh l I was just gonna address a couple things uh that were mentioned [1:18:31, 1:18:39]: Number one, in terms of infrastructure, you really can't compare the infrastructure on Flippin' Road today to what it will be when this development's built. If you if you zero in on the site plan, you'll see [1:18:40, 1:18:41]: Yeah, the improvements were [1:18:41, 1:19:01]: We're making on that roadway, which should make things better and certainly minimize and mitigate the impact of this particular development. Uh we've, as I mentioned, we've got a turn lane, we've got a deceleration lane, we've got a traffic signal. Um you know, we've got sidewalks. Someone mentioned this isn't a great area for foot traffic. Well, it will be because we're gonna put a sidewalk along the entire [1:19:01, 1:19:05]: So it will become walkable. [1:19:05, 1:19:09]: uh once that comes in. So, you know, again, uh we [1:19:10, 1:19:23]: I understand the anxiety about these kind of impacts, right? But we have spent a year dealing with the city and uh regional uh entities to sort of go through those things and make changes. Uh [1:19:26, 1:19:45]: Someone made a comment about uh you know the belt line. I'm not saying that that trail is the belt line. My only point was that on the belt line you can step off and get a ice cream cone. You know, that's kind of what we're trying to do here. We're not trying to reestablish the belt line, but we think it would be a nice amenity if you're walking on that trail to be able to stop and do something, uh grab a cup of coffee or something. Um [1:19:45, 1:19:57]: In terms of my letter, you know, I hear that you hear that every time. You hope frankly that they sh share that that letter with their neighbors. There's always some on the other side of that line. [1:19:57, 1:20:08]: Uh you know, I'm happy to have a community meeting. We've got s a a lot of time between or some time between uh this hearing and and the city council meeting, so I'm happy to come out. I don't know who said [1:20:09, 1:20:13]: There she is. I'm happy to come out and talk to you and your neighbors and answer any questions you have. [1:20:13, 1:20:20]: I think we've got answers really to all the things that you raise and I've covered some of that tonight, but I'm happy to do it for you and and your neighbors. I mean [1:20:21, 1:20:41]: One of the things that that cannot be lost in this conversation is that while this is uh uh this is not a new development, right? I mean, four years ago this development was zoned in Henry County. It could have been built in Henry County until uh uh uh January of this year. We started the process in Henry County for the record. But we're in Stockbridge now, as of uh about four and a half months ago, and we're really [1:20:40, 1:20:56]: really just trying to transfer our entitlements over. And again, fortunately, the city's given us the zoning we need, but they weren't uh uh in a position to, you know, advance a regulating plan on our behalf or real here really to do that ourselves. We have to do that ourselves. So we're, you know [1:20:56, 1:21:11]: basically preserving the entitlement that exist existed for about four years until a couple months ago. And the good news is I think that this development is better in a lot of ways than what a what was built or what was approved by Henry County. So I think I'll stop there. Thank you. [1:21:13, 1:21:16]: Uh that closes the uh public comment. [1:21:20, 1:21:23]: The board, we have a motion. [1:21:26, 1:21:26]: Yeah. [1:21:47, 1:21:50]: What was your motion, uh Mr. Plusan? [1:21:51, 1:21:52]: Last one moves your motion. [1:21:52, 1:21:55]: That we accept the the [1:21:56, 1:22:01]: Development use uh amendment for this project. [1:22:01, 1:22:03]: Mr. Doom, was you seconded? I did. [1:22:04, 1:22:10]: All those in favor, let it be known by a sign of aye. Aye. Aye. Those opposed? Aye. [1:22:12, 1:22:15]: We have one opposed. [1:22:21, 1:22:36]: Ayes have it. I'm just I'll just count to make sure. It's been moved and s second. Uh all those in favor, let it be known by sign of I we have one uh opposed. The eyes have it. The uh development is uh motion is approved. [1:22:39, 1:22:45]: Item uh nine, rezoning case RZ twenty twenty two dash oh five. [1:22:57, 1:23:17]: Rezoning case RZ 2022. [1:47:27, 1:47:28]: Uh [1:47:28, 1:47:30]: recently and therefore that [1:47:31, 1:47:38]: Conditional use permit from Henry County became void. So now he comes to the city to seek a conditional use permit. [1:47:39, 1:47:47]: So we have on the agenda the related uh applications for uh rezoning of the adjacent property. [1:47:47, 1:47:55]: uh to the west and that's on parcel number oh two nine oh one oh oh nine oh oh one on Valley Hill Road. [1:47:55, 1:48:09]: and as well as a comprehensive plan amendment application and a variance application. I'm mentioning these because the applicant has submitted a joint site plan for both developments, so everything is interrelated. [1:48:11, 1:48:13]: Let me point out the property itself. Um [1:48:14, 1:48:19]: As as anyone who goes to the tax Henry County Tax Assessors website [1:48:19, 1:48:21]: Looking for [1:48:21, 1:48:24]: This адрес о семтер род. [1:48:24, 1:48:25]: This is what they would see. [1:48:25, 1:48:26]: Um [1:48:26, 1:48:34]: And then this is the adjacent parcel actually surrounding it. That has changed recently because the applicant has already [1:48:34, 1:48:37]: officially combined these two parcels. [1:48:37, 1:48:42]: through the recombination process and um got a recorded plat [1:48:42, 1:48:45]: Uh handled by Superior Court on May second. [1:48:46, 1:48:46]: And so [1:48:47, 1:48:51]: Now the parcels actually look like this. Um [1:48:51, 1:49:02]: The yellow parcel on the east is the seven thirteen Valley Hill Road and then on the west in the orange is the adjacent parcel where the town home development would be built. [1:49:11, 1:49:16]: I've already gone through this. Um the applicant currently um [1:49:16, 1:49:21]: is operating a church within council district four. [1:49:21, 1:49:35]: It's on North Henry Boulevard, six oh four three North Henry Boulevard. That is in a commercial center, uh basically right across from where Valley Hill Road intersects with North Henry Boulevard. [1:49:36, 1:49:45]: So he's operating there and would like to now move the church into a new building that he wants to construct on subject property. [1:49:47, 1:49:51]: Here is surrounding zoning. The property is right here in this area. [1:49:51, 1:49:55]: Now we have uh rural residential in the buff color. [1:49:55, 1:50:03]: And we have uh in blue uh PUD, the um Valley Hill Station Um Subdivision. [1:50:04, 1:50:10]: Uh Davis Road is down here to the south and as you know in our last set of meetings [1:50:10, 1:50:15]: We had um council approved on this property another town home development. [1:50:16, 1:50:29]: Here is the surrounding land use designations. Um we have low density residential along Valley Hill Road, and then we have uh Clayton County owns a large [1:50:29, 1:50:32]: Um water treatment facility here. [1:50:32, 1:50:36]: In a slate color, and then Georgia Power has a small operation. [1:50:36, 1:50:37]: Uh next to it. [1:50:41, 1:50:47]: Let's see, I've already covered a lot of these facts. The property is fairly level and partially wooded, but the front part [1:50:47, 1:50:53]: Along Valley Hill Road is the lowest area and that's where a detention pond would be would be built. [1:50:54, 1:50:55]: Um [1:50:57, 1:50:58]: Okay. [1:50:59, 1:51:06]: So as far as the proposed development, um the joint s site plan, let me pull that up here uh quickly. So [1:51:07, 1:51:16]: Um it looks like this. This is the official plan that has all the um architects um information here on the side. I enlarged it a little bit here. [1:51:17, 1:51:17]: Um [1:51:18, 1:51:29]: And so this will show the church building here in brown, and then the parking lots in a bright blue. And um and this would be a central [1:51:30, 1:51:33]: main driveway serving both developments. [1:51:33, 1:51:38]: And then over here on the west side you'd have uh town town home buildings. [1:51:38, 1:51:40]: Uh, here in the Navy blue. [1:51:43, 1:51:46]: Let me go back up here to these other slides. [1:51:47, 1:52:05]: So uh anyway the uh sanctuary building would just be one building right now, would have twelve thousand five hundred eighty-six total square feet and the largest assembly area would have thirty-three fifty square feet. That's important because the amount of required parking is based on that. [1:52:06, 1:52:09]: Town homes there'd be fifty six units, all three or four bedrooms. [1:52:10, 1:52:13]: and at a density of seven point one two units per acre. [1:52:15, 1:52:25]: Um so I mentioned all this um there would be an interior looped street um to serve uh the town home portion. [1:52:28, 1:52:31]: The sidewalks will be six feet wide on both sides of the street. [1:52:32, 1:52:33]: And um [1:52:34, 1:52:36]: Now the setbacks for the town home lots. [1:52:37, 1:52:52]: Um the applicant has also applied for a variance. That's the subject of one of our next cases to reduce the front yard setbacks from the required uh fifty feet to twenty five feet. That's in the MFR multifamily residential district. [1:52:52, 1:52:54]: I'll be talking more about that later. [1:52:54, 1:52:58]: There would be fifty foot buffers at the rears of the town home buildings. [1:52:59, 1:53:05]: Menatees would be provided a recreation area with gazebo, with a pavilion, playground, barbecue area. [1:53:06, 1:53:09]: And two small park areas would be at the central portion of the development. [1:53:11, 1:53:23]: So back here again. So we have a detention pond up here. This is the main driveway, detention pond and uh park areas here in the center. I think there would be a mail kiosk. [1:53:23, 1:53:27]: in this area too, applicants still trying to work that out. [1:53:27, 1:53:28]: Um [1:53:28, 1:53:35]: Emergency vehicles would be able to circulate around easily and turn around here at the end of the street. [1:53:36, 1:53:40]: Here's um some renderings of how the church building would look. [1:53:41, 1:53:53]: Here in the front, you'd have a main uh entryway here, covered entryway, here's a side elevation, and then then of course um the left left end. [1:53:54, 1:53:55]: The length of the building. [1:53:57, 1:54:05]: The applicant as for for a the UDC requires that the applicant submit a parking plan. [1:54:05, 1:54:10]: For a worship center. I won't go through all this, but I'm just showing you that he did submit one. [1:54:11, 1:54:13]: And it talks about um [1:54:13, 1:54:17]: number of parking spaces and oper operational times. [1:54:18, 1:54:18]: Um [1:54:19, 1:54:23]: uh church would operate between nine AM and twelve noon. [1:54:23, 1:54:24]: Um [1:54:25, 1:54:29]: Sundays and then Wednesday between seven PM to eight thirty PM. [1:54:30, 1:54:39]: Um currently the church membership is about one hundred. Uh of course the church hopes to grow and um [1:54:40, 1:54:43]: There would also be some times of special events happening. [1:54:43, 1:54:51]: And the applicant is um planning has contingency plan for parking maybe maybe by providing some [1:54:51, 1:54:52]: Hmm. [1:54:52, 1:54:54]: Bus shuttles from a nearby property. [1:54:55, 1:54:59]: And and the current seating capacity would allow three hundred. [1:55:00, 1:55:03]: And that seems to be adequate at this time. [1:55:06, 1:55:08]: Let's see. [1:55:08, 1:55:10]: All right, so I've covered these. [1:55:12, 1:55:18]: Now uh the are some standards in the unified development code for places of worship. [1:55:19, 1:55:31]: And um there's a minimum site area of two acres. He has actually has four acres. Road frontage two hundred feet, exceeds that. Buffers side and rear of twenty feet, that's been met. [1:55:31, 1:55:34]: uh sp specified building materials. [1:55:34, 1:55:39]: And a setbacks fifty feet from all property lines. Those requirements have been met. [1:55:41, 1:55:49]: Um there are also some requirements on accessory uses. Some are allowed, but the applicant does not propose any at this time. [1:55:49, 1:55:51]: Although um [1:55:51, 1:55:57]: Daycare center could be allowed, but not on this property because of its residential zoning. [1:55:57, 1:56:04]: And Fellowship Hall, there's no plans for that right now. It's part of the same sanctuary building. [1:56:05, 1:56:20]: Uh parsonage. This is where a pastor would live on a separate building on the property. There is a existing house on the property and that would continue to be used as that, but the pastor would not live there. [1:56:21, 1:56:22]: At this time. [1:56:22, 1:56:24]: If that were to change, we should [1:56:24, 1:56:28]: than uh a separate a parsonage lot [1:56:29, 1:56:36]: would have to be uh d delineated on the property for that purpose of at least eight thousand square feet, not of the house but of the [1:56:37, 1:56:38]: The land area. [1:56:39, 1:56:41]: Plus two parking spaces. [1:56:41, 1:56:45]: Uh he has provided a specific parking plan. [1:56:46, 1:56:47]: Let's see. [1:56:49, 1:56:55]: There are additional required setbacks for the sanctuary of five feet. [1:56:55, 1:57:00]: For each additional two thousand feet, the site plan does meet that requirement. [1:57:03, 1:57:11]: As far as our analysis we had to look at the the standards for places of worship that I just went through and I've covered these already. [1:57:12, 1:57:12]: Um [1:57:13, 1:57:20]: And these accessory uses uh we've actually gone through these. Um okay. [1:57:21, 1:57:26]: Now there's a separate analysis uh in general for the granting of conditional use permits. [1:57:27, 1:57:33]: So A proposed use shall not cause traffic congestion or conditions that'll bursely affect nearby properties. [1:57:33, 1:57:35]: So the applicant is [1:57:35, 1:57:37]: Position the project entrance. [1:57:39, 1:57:44]: In an acceptable location, this an engineer determined that because of the curvature of the road. [1:57:45, 1:57:48]: that therefore the project interest needed to be put [1:57:48, 1:57:51]: In the spot where it's indicated on the site plan. [1:57:52, 1:57:59]: Um we don't expect any weekday rush shower traffic uh generated from this because of different operational hours. [1:57:59, 1:58:06]: I mentioned the detention pond having to be located uh at the low point of the property at the front. [1:58:12, 1:58:12]: Um [1:58:13, 1:58:17]: The staff findings we found that the uh uh applicant wants to [1:58:17, 1:58:21]: construct a church on a building with on property which has already owned [1:58:21, 1:58:23]: Форс твітаза фа. [1:58:24, 1:58:29]: And as I mentioned, the conditional use permit was previously obtained from the county. [1:58:30, 1:58:30]: Um [1:58:32, 1:58:40]: And the standards of places of worship have been met. In view of all these facts and our analysis, we feel that this uh proposal. [1:58:40, 1:58:44]: For a place of worship on the subject property should be approved with conditions. [1:58:45, 1:58:46]: uh those conditions being [1:58:47, 1:58:48]: The site plan that was submitted. [1:58:49, 1:58:57]: And um with also that if any additional buildings, uses and activities are proposed, they shall meet the requirements. [1:58:57, 1:59:02]: uh sec subsection three point two point twenty four E the Unified Development Code. [1:59:02, 1:59:08]: I mentioned the requirement about the parsonage lot and no day care centers shall operate on the property. [1:59:09, 1:59:14]: Uh, regarding parking is another condition to prov to make sure there's ample parking and if [1:59:14, 1:59:19]: for special events as well as expanded church membership. [1:59:22, 1:59:23]: Are there any questions? [1:59:36, 1:59:38]: No question. Why don't we open it up for public comment? [1:59:41, 1:59:43]: Those in support, those opposed. [1:59:45, 1:59:50]: think we should hear from the applicant before we do that. So we come up with that. [1:59:50, 1:59:54]: Yeah, they have to keep that. [2:00:03, 2:00:06]: Does the applicant want to make a presentation first? [2:00:07, 2:00:08]: Thanks so. [2:00:10, 2:00:11]: Yeah, I just said. [2:00:15, 2:00:34]: Okay. Chair Chairman Abdullah, uh uh just a a point of order for the public hearing process. The applicant has the option to come up and speak. They have ten minutes to speak at this time. And then following that, any questions you all have, and then we would need to open it up for public hearing. Yeah. Just for the for the benefit of the people. [2:00:37, 2:00:44]: So in the in the order of of the process, it will require that the acting come up and speak towards his his project. [2:00:47, 2:00:53]: Good evening, Commissioners. I'm Reverend Nation. I am the Pastor Victory Worship Center, the proposed [2:00:54, 2:00:57]: Um plans that have been discussed so far. [2:00:57, 2:01:03]: I I decided I would not make any initial remarks because I was wanted to hear the [2:01:03, 2:01:06]: concerns of the residents, but I would say this that [2:01:06, 2:01:11]: We began this project about some four tін plus єр зако. [2:01:12, 2:01:17]: And we've had a number of setbacks uh trying to get uh this project off the ground. [2:01:17, 2:01:23]: Initially, we heard uh some concerns when we first were part of Henry County. [2:01:23, 2:01:27]: А концерн да ви ток і то грайкосин. [2:01:27, 2:01:31]: There was a meeting of the minds, and we came to some. [2:01:31, 2:01:34]: Common ground, and we were able to. [2:01:34, 2:01:53]: uh do some things to which we were able to get the conditional use permit granted. Uh of course there were a number of things that we uh could not move the project forward. So here we are now. Having done a number of things, uh we wanted to make certain that we were going to take into consideration what impact it would have on the community. [2:01:53, 2:02:13]: The fact is that we are going to be a part of that community, and we did not want to infringe upon the residents there. We have a long-term commitment to that part of the community. We have been there for quite a number of years. Our intend is that we want to add to the community. We want to have a positive. [2:02:13, 2:02:15]: positive impact on the community. [2:02:15, 2:02:30]: When we started, we were considering to build a perhaps I would say about 70 plus units, townhouses that is. But with a number of considerations and concerns by the city planners, we had to scale that project back. [2:02:30, 2:02:40]: Uh we had a number of instances where the city planners uh held our feet to the fire and required of us to do a number of things to make certain that we would meet. [2:02:40, 2:02:43]: the concerns of the residents of the community. [2:02:43, 2:02:46]: And we thought we did that to the best of our ability. [2:02:46, 2:02:58]: Uh we can't be certain that we've done everything that we can uh satisfy the concerns of the residents. However, I'm hopeful that we can here tonight address any concerns they may have. [2:02:58, 2:03:18]: But I would venture to say that we have done a number of things to bring us to this point. Hopefully, with um uh all considerations and concerns met, we can receive your approval to move this project forward. So I I'll hold back a uh a little bit of my time and to uh allow the uh citizens to come forward unless you have any questions. [2:03:18, 2:03:20]: Questions of me while I'm standing. [2:03:21, 2:03:21]: Yeah. [2:03:22, 2:03:24]: Anybody. [2:03:25, 2:03:28]: No, we're open up for public comments. Okay. Thank you, sir. [2:03:32, 2:03:37]: This items are now open for public comment. Those in support or opposed to the project. [2:03:38, 2:03:40]: Oh well, right there. [2:03:43, 2:03:48]: Have you signed up to [2:03:58, 2:04:12]: Good evening. My name's Anthony Mitten. I live at 164 Valladale Drive in Stockbridge in Henry County. I've lived at my property for thirty years. It abates the property that's proposed for variance and development. [2:04:14, 2:04:17]: Ай персональ на опоздов ворші. [2:04:17, 2:04:23]: On a piece of property, but what I am concerned about is the church's ability to start a project. [2:04:24, 2:04:28]: That maybe they can't afford. They've owned the property since two thousand five. [2:04:29, 2:04:31]: The property is currently overgrown. [2:04:32, 2:04:37]: Has a dilapid dilapidated sign on the property that states that it's the future home of the church. [2:04:38, 2:04:39]: Not town homes. [2:04:41, 2:04:43]: So I am concerned first and foremost about that. [2:04:44, 2:04:48]: One condition that I would request prior to this panel's approval [2:04:49, 2:04:52]: Із-таки девел schedule a community forum. [2:04:53, 2:04:58]: To talk to us about the proposed development, to the residents specifically. [2:04:59, 2:04:59]: Okay. [2:05:00, 2:05:01]: Um [2:05:02, 2:05:06]: I will say one particular concern that I have is that [2:05:06, 2:05:11]: If the church is what appears to be having trouble maintaining the property, [2:05:12, 2:05:14]: That this is gonna be a phased approach. [2:05:14, 2:05:16]: With the town homes being built first. [2:05:18, 2:05:19]: To find the church. [2:05:20, 2:05:40]: And personally that would not be my preference. I never saw the property as a residential area. It was always proposed as a church, which once again I'm not against. So I would request the developers schedule a community forum prior to the twelfth June council meeting. Thank you. [2:05:40, 2:05:40]: Mm-hmm. [2:05:42, 2:05:43]: So [2:05:45, 2:05:54]: I was just gonna s uh Raymond King, I live at one we live at one twelve and we would just support his proposal. He submitted to y'all. [2:05:54, 2:05:55]: Thank you. [2:05:59, 2:06:00]: Mr. Alfred, you'd like to speak again? [2:06:03, 2:06:03]: Sorry. [2:06:06, 2:06:26]: Jocelyn Williams, one ninety Banks Drive, Scott Bridge, Georgia, three hundred two eight one, Henry County. I'm in opposition to the um building of this unit and the rezoning because it is a residential area. Like the gentleman before me, I've been here since nineteen ninety two. Infrastructure is critical. [2:06:26, 2:06:46]: It's a two-lane highway, uh two-lane road. And what would happen when when you build fifty uh town homes within that area, it's just gonna cause more traffic. And um I would oppose it changing because once we change into [2:06:46, 2:07:06]: to a PUD, then once again it comes into a high density area and we don't have an infrastructure. We're building, we're permitting, and just like my neighbors have said, it's nothing I can do, but I do want my voice uh heard that whenever something is being built, I will always come in uh opposition. But I can't thank you enough for [2:07:06, 2:07:08]: allowing me to speak at this time. Thank you. [2:07:21, 2:07:27]: Good evening. I'm Donna Dank. I live at three oh six Grove Hill Drive. We were at the Williams [2:07:28, 2:07:28]: Ah. [2:07:30, 2:07:46]: Turned it off. Um the Transcontinental Pipeline meeting the other evening. On the rendering there was no statement that the William um Williams Transcontinental Pipeline is right across the pumping station is directly across from this property. [2:07:46, 2:08:06]: I just wanted to point that out because it is there. It wasn't on the rendering. Um these the road that this would be off of there is an accident very often. I know that they said that the um entrance would be on the flat part, but it is like the lady that was just [2:08:06, 2:08:20]: before me said it is a very busy road and it's one way and it's very, very um has a very high um topography. I don't know if you've ever driven on Valley Hill Road, but it's it's [2:08:21, 2:08:27]: They race on that road, okay, and there's been a lot of accidents on there. So the concerns of the traffic and [2:08:28, 2:08:40]: the um the danger of it as well. I know it would be Sunday morning for church and Wednesday evening for church, but my concern is the added traffic from the townhomes as well. [2:08:41, 2:09:01]: And I do believe I know that only the people that we know of that are up butt up against the property were given the letters. But like I said, we were at the meeting the other night about the um transcontinental pipeline is when we that was the first time we found out about this. And like the gentleman before um stated that [2:09:01, 2:09:12]: Um it has always just been a proposal for the church. And this this week was the first time that we heard that there was going to be townhomes as well. So thank you so much for your time. [2:09:16, 2:09:16]: Mm-hmm. [2:09:19, 2:09:27]: Would you read no no no mic. Repeat your name and address so she can hear you. I did. Okay. Donna Dink, three oh six Grofield Drive. [2:09:38, 2:09:38]: Go ahead. [2:09:49, 2:10:09]: I'm certainly happy to hear the concerns of the residents. Let me begin first of all to address the uh the fact that this was not um there was no town meeting prior to this meeting. Um our instruction was to notify the residents that was adjacent to our property. [2:10:09, 2:10:29]: Can you hear? Oh. Okay. And um and we did so. We're not opposed to having a meeting. In fact, if time permits before the 12th, if the commissioners so uh dictate that we do have one, uh we'll certainly make the arrangement to do so. Uh we we want to take into consideration [2:10:29, 2:10:49]: The residents' concerns. We don't want to infringe upon their long standing residence in that part of the community. Apart from that, I want to just talk a little bit about the fact that the uh there was nothing mentioned about townhouses prior to the top of the top. [2:10:49, 2:10:55]: to this uh meeting uh prior to the announcements letter now announcements that had gone out. [2:10:55, 2:11:02]: Our original plan uh when we started uh back in 2006, our plan was to first build a church. [2:11:03, 2:11:23]: And then our plans was to build condominiums. That's what we were intended to do. We were going to do it in phases. The plan was to first build a church and then condominiums. A number of things happened, and uh need not needless to go into that, we decided to put the plan on hold. We needed to regroup and readdress some of the major concerns. [2:11:23, 2:11:43]: Concerns we had internally within the ministry. And so we have come to this point now, realized that we can only do townhouses. And that's why we're moving into that direction. As I mentioned before, we started to build about 70 plus townhouses. But the [2:11:42, 2:11:51]: The pl city planners admonished us that would be too many for the size property. Of course, we needed to take into consideration parking. [2:11:51, 2:11:57]: That was a b uh most important part of our plan. So uh the number of uh units have been reduced. [2:11:58, 2:11:59]: uh to where it is currently. [2:12:00, 2:12:20]: Um we uh we want to uh make sure that the residents do understand that um traffic uh is our concern and uh we will make sure that going into the development of the project we will have a better appreciation for what we need to do. The developer is not going to build the townhouses. [2:12:20, 2:12:37]: In one complete phase. He's going to do it incrementally. The church, of course, will be going up with the first building, but as as so far as the townhouses, they were not building it completely at the in one setting. [2:12:38, 2:12:44]: uh that would give us some time to really get a good sense of how things would uh flow within the community. [2:12:45, 2:12:49]: I think I need just mention one other thing and then I'll I think I would have exhausted my time. [2:12:49, 2:13:09]: And that is uh the fact that the the property has been overgrown. Uh unfortunately we we had no intentions of it being overgrown. It uh we felt it was far more prudent for us to put those funds into an account rather than paying someone to cut that uh the grass. It wasn't being used for anything. [2:13:09, 2:13:29]: useful. And so unfortunately, hopefully I offer an apology to the residents if it was creating an eyesore for them and uh hopefully we can address that quickly. But uh we're coming into that community. We want to work with the residents there. Uh we want to make sure whatever we do, uh we can have [2:13:29, 2:13:49]: a long-term relationship. So we're we have a listing here and we want to make sure that we're going to do everything we can to be a good uh resident of that community to which they'll have no disappointment that we're there. If there's no questions of me, I'll I'll have a seat unless anyone has any uh further questions. But I [2:13:49, 2:13:51]: I I trust that the [2:13:51, 2:14:11]: Uh w not overlooking their concerns or which we want to address. I trust that the commissioners will uh allow us to move forward. It's been uh 14 long years plus, so we we're hoping that this time we can move the project forward. Well, there was two questions raised. Yes, sir. From the public. One of them was that they didn't understand how [2:14:11, 2:14:31]: How you could afford to uh erect a church when you have maintained the land. Uh and so I I I I would if if I were you, I think that first thing I would do is I would clear that overgrowth. Uh uh it would reduce any questions of concern about your financial ability to. [2:14:31, 2:14:48]: erect this this edifice. Um the other thing is that if I were you, I would meet with the residents to really disclose to them exactly what's going on. One of the things they pointed out was that it's always been a sign up there for a church and not town homes. And so [2:14:48, 2:15:08]: It looks a little from their perspective I'm looking a little deceptive because they're expecting that church and now we got a development. And so I mean, you want to be part of the community, you need to disclose I think you need to disclose all that to the community and have a meeting with them. That's not me. I'm just saying what I would do if I were in your position. [2:15:09, 2:15:19]: Certainly I received that and having heard that, it would be our intentions to do precisely that. Uh let me just say this, the the the property is divided into two lots. [2:15:19, 2:15:39]: Uh the house was originally sitting on about an acre plus. We have been maintaining that all along. Originally we were keeping the grass cut on the larger portion. Uh there's nothing that uh we would uh find useful to maintain it. Uh we didn't consider it to be a problem uh had it been broken. [2:15:39, 2:15:59]: Brought to our attention, uh, we certainly would have addressed that. Uh, and at this junction, if if that is uh an issue, I I simply say this: the the uh the overgrowth is uh something that we're gonna address immediately uh once we have the approval to move forward with the construction plans. But the if you go to the property where the house [2:15:59, 2:16:15]: is that area's always been maintained and cut and kept well groomed where the house is. So we have been doing that since uh ownership. But I I I take uh I don't make light of what you're saying. I I do take that onto cos into consideration. [2:16:15, 2:16:16]: Yeah. [2:16:17, 2:16:17]: Okay. [2:16:23, 2:16:40]: I think that's it. I mean they've they've already voiced their opinion about it. I I'd be saying I only comment I was making is that I would address those issues to eliminate any uh negative comments about uh yes the the idea, the proposed project. [2:16:40, 2:16:54]: And and what we'll do is um we'll move immediately to make some plans to has set up a community meeting where we can explain fully what we're our intentions are and uh so the residents uh their minds will be cleared. [2:16:54, 2:16:58]: We'll we'll do that. Uh that's something we'll not uh overlook. [2:16:59, 2:16:59]: Okay. [2:16:59, 2:17:01]: Can we add that as conditions? [2:17:01, 2:17:02]: Yeah. Okay. [2:17:06, 2:17:26]: Okay. Thank you, sir. I have a question for you, sir. Mr. Chairman, if you don't mind. You recently replanted that that, you know, you combined two lots. Uh the new plat, do you are you gonna have two separate lots, the four acres and the seven, or is it it's uh it's been uh uh di divided. So you have two [2:17:26, 2:17:46]: Parcel. Two parcels at this time. Yes. Well they will they have the same parcel numbers that no uh they we're we're gonna have that uh change that's gonna be changed. They're gonna be new parcels. Okay. So the commit the condition of use that you're asking for only applies to the four acres. For the four acres at this time and then gotcha, of course, yeah. [2:17:46, 2:17:47]: Yeah. Okay. Yeah. [2:17:48, 2:17:49]: Um [2:17:50, 2:17:55]: The con the townhomes that you anticipate building oh [2:17:59, 2:18:16]: Is that predicated on the church being built or is the church being built predicated on the town homes? Uh no is the uh we we have a we're working with a developer who is going to be funding that project separate from the church. The church is gonna fund the building of the church separate. [2:18:16, 2:18:23]: Асорин від аделопер. So we're not entirely dependent upon that project be built. [2:18:23, 2:18:27]: Of course, there are certain benefits that will come as a result of that. [2:18:27, 2:18:41]: Uh but uh the there's two separate funding uh that that's um if I hopefully I'm answering your question, that's gonna address I guess what I'm trying to get at is if if for some reason the church is not approved [2:18:43, 2:19:00]: Could the town home still take place or vice versa? If the townhomes are not approved, could the church still take place? Well um there we we're still in the um preliminary phase of that. I'll say this that the townhouses uh can go forward. [2:19:00, 2:19:14]: um uh w without the church. Um uh the church can be built. Uh there's certain things that needs to be done, uh primarily uh the infrastructure, uh the road. [2:19:14, 2:19:16]: uh detention pond [2:19:16, 2:19:21]: That the church will uh need to have access to the fact that the [2:19:21, 2:19:24]: um the the development housing part of that [2:19:25, 2:19:29]: Існує в досчу адемс, вч<unk>рч ви рейон. [2:19:29, 2:19:47]: Which it more or less alleviates some of that expense. So um but to answer your question, we could go forward. We just have to change the entire uh plan uh c planning consideration in order for that to take place, which which would make it a little bit more challenging if we were having to do that. Okay. [2:19:47, 2:19:50]: Did you contemplate building town homes? [2:19:51, 2:20:11]: As owner occupied town homes or is there a possibility that they would be rented? Oh no. Uh it would be unfortunate if we consider renting. That's not our consideration because we're sensitive to our neighbors. Uh that the biggest thing that uh we would uh not want to do is to impose on them. [2:20:11, 2:20:14]: А рез, пика жіно, рез. [2:20:15, 2:20:30]: uh will not take uh as much interest in the maintenance of their property as uh owners will. So our plan calls for owners uh to uh take uh individual families take ownership of those townhouses. That's what we're we're looking for right now. [2:20:31, 2:20:36]: Did you anticipate having an HOA? Yes, we're that's something we're working towards as well. [2:20:37, 2:20:40]: Okay. I read in some of the documents that you [2:20:41, 2:20:42]: Plan to keep [2:20:42, 2:21:02]: maintenance of the road until a a later date rather than dedicating it to the city once the road is complete. And I was concerned because if you do that, that would put an unnecessary burden on the HOA, it seems to me. [2:21:02, 2:21:22]: Um one of the things that and unfortunately I do have the architect here, unfortunately developer had a uh uh pre-arranged uh meeting, could not make it here, that would be something that I would uh defer to him. His suggestion would be uh that short term the we would have uh the [2:21:22, 2:21:42]: the uh main entrance uh as private and um and at some future date uh make that public. Um of course uh we we can look at whatever suggestions that would may be uh put forward but at this time that's one of the things that he suggested that we would do so we were more or less following [2:21:42, 2:21:44]: When uh his guy dies. [2:21:46, 2:21:47]: Mm-hmm. [2:21:50, 2:21:52]: The existing Rotherdown. [2:21:54, 2:21:58]: Is that gonna be part of the church function? [2:21:59, 2:22:19]: The the house that's there now, it would be part of the church. Uh we're exploring a number of possibilities. Um of course we're always going to keep in mind that uh planners uh we have to uh use them as a as a um an approval for anything that we may plan to do futuristically. [2:22:19, 2:22:23]: But to answer your question is part of the uh church uh infrastructure. [2:22:26, 2:22:29]: Which would make that also an exempt property. [2:22:32, 2:22:37]: The whole church structure and the existing would all be one parcel. [2:22:38, 2:22:41]: Yes, that's one parcel. Yes, that's correct. Yes, correct. [2:22:43, 2:22:51]: I have a question. The church that you're proposing for this development, does it already have a congregation someplace else? [2:22:51, 2:23:11]: Yes. Uh we are currently meeting just uh less than two blocks away. Uh we're in a commercial we're in a commercial building. And and I I'm glad you raised that question because one of the challenges we're having now where we're currently located and we're facing some enormous uh difficulties. Uh the it's a commercial area. [2:23:11, 2:23:31]: Area. We first moved in that complex, and since then there's been I think six or more ministries have moved in. It's quite congested on Sunday. Things that we want to do in order to grow the ministry and to have community programs, we're hampered in that location. So it's uh [2:23:31, 2:23:45]: uh critical for us to have a location where we can do those um ministry programs and of course uh make it uh more feasible and comfortable for our uh parishioners when they come uh to church on Sundays. [2:23:45, 2:23:54]: How far away does your current prisoner come from? What's the furthest one away do you think? The majority are in the Henry County area. [2:23:54, 2:23:59]: А ви до фамилии з outside of Henry County. [2:23:59, 2:24:03]: uh but the majority of them are in the enry county area [2:24:04, 2:24:15]: So you don't you don't think people that purchase these town homes would be objectionable to somebody from the outside coming in twice a week to into their neighborhood? [2:24:16, 2:24:18]: In terms of uh worship. [2:24:18, 2:24:30]: Yeah yes. Okay. I you know, I I'm not sure if that would pose a a a great concern for one, uh we only have services on Sunday for two hours. [2:24:30, 2:24:34]: А курнли ви док сервис ом. [2:24:35, 2:24:42]: And we're doing that for the foreseeable future. It seemingly works for busy families. Um I cannot say at what point we may. [2:24:43, 2:24:45]: Гото Мідвик сервис і персона [2:24:46, 2:24:50]: Аботн Сандайс ви. [2:24:50, 2:25:02]: And um at the time we start, uh interestingly I would say this, that when we first started to build the church, we're putting that building on the western side of the property. [2:25:02, 2:25:22]: Uh, if I'm looking at it correctly, yeah, western side of the property, uh, which was more closer to the residents. Uh because of some of the concerns raised, we decided that we'll put it on the eastern side. So the church is much further away from the residence that the closest uh residence uh to us is a single family house. [2:25:22, 2:25:36]: house. But the townhouses, of course, are going to be adjacent to the residents. And if there was a concern for noise that that should be minimized if if that would be a an issue with the residents. [2:25:36, 2:25:53]: I can see the benefit of developing the church first. That way anybody moving in there would know ahead of time that there is a church inside of this development. Yeah. So that's it. Well, certainly that's that's a number of considerations we've had and we're viewing all the possibilities. The most important thing we wanna [2:25:54, 2:25:57]: get disapproval so we can move to the next phase. [2:25:58, 2:25:59]: Yeah. Thank you. [2:25:59, 2:26:17]: The town chairman, the town homes are open to anyone to um purchase or it's Absolutely, absolutely. Not parishioners alone. Anyone can purchase. No one is restricted, no race, no um background. We're not uh putting any um uh uh limitations on who can live there. [2:26:17, 2:26:22]: Um hopefully those who move in would want to worship with us. We certainly would love that. [2:26:25, 2:26:35]: If approved, what's your anticipated build out schedule for the church as well as the townhomes? How far down the road are we looking? [2:26:35, 2:26:54]: Well, um my best estimation, I wish the developer was here. Uh my best estimation would be uh the earliest we could possibly begin to uh develop the property would perhaps be sometime in the fall, I I would say, because we still have to get through uh the city council. [2:26:54, 2:27:11]: Uh we do not know what they may impose upon us and then w we have to then proceed with all the plans, complete the plans and get their approval. And of course, uh we don't know what uh hurdles we may have to overcome to get it done. So my best guess is that perhaps I'm gonna fall. [2:27:11, 2:27:14]: So a twenty twenty three start date, what about a end date? [2:27:15, 2:27:35]: Uh if we are able to get the church started in the fall, I would say by December we should have the church up. As far as the townhouses, uh, the developer has indicated he wants to build it incrementally. Uh and I guess what he's thinking is based on uh needs. If if when building the first building that uh buyers are there. [2:27:35, 2:27:50]: He'll move immediately to build the next building. But if the market is slow and um and there aren't any uh buyers, I I can assure you that the project will be put on pause uh so we cannot predict what the end date might be. [2:27:52, 2:27:54]: But hopefully uh spring of next year. [2:27:55, 2:28:01]: at the latest if I if I would uh if I could say anything. Hopefully. I don't know. I I think my time is up. [2:28:02, 2:28:20]: I hope I have not said too much. They said don't give a preacher a microphone. Okay. Have I have I answered all questions? And please I'd love to get with you. I'd I most certainly would love to get with you. And whoever the key person is, I'd like to get your telephone out. Okay, go ahead. [2:28:21, 2:28:30]: I'm sorry? Price price. Price point. Uh we had a discussion with the developer. Uh first of all, he is looking at what the comps are in the area. [2:28:30, 2:28:44]: And uh he has thrown out some numbers, but uh let me caution you here because they're still tweaking the cost for development and that is gonna be key in determining what the price is, but he has thrown out some numbers, say l [2:28:45, 2:28:58]: Low three hundreds, perhaps mid three hundreds, I don't know. Uh let me not uh put anything out there concrete. I'm just saying that uh he has uh thrown out some numbers. But what's gonna decide that is [2:28:58, 2:29:00]: What the comms are in the area. [2:29:00, 2:29:18]: He certainly wants to complement the the value of the homes in the area. We're not want to undercut the value of the what the residents' uh properties are. So certainly we want to, if nothing more, increase their value based on whatever we're going to put there. So it's a number of things we're looking at. [2:29:21, 2:29:23]: All right, thank you very much. Okay. [2:29:24, 2:29:27]: But you're still on the [2:29:27, 2:29:28]: Yeah. [2:29:28, 2:29:29]: I'm sorry. [2:29:29, 2:29:31]: They're gonna be in our backyard. [2:29:34, 2:29:35]: Yes. [2:29:35, 2:29:37]: All right, real quick. [2:29:38, 2:29:38]: Real quick. [2:29:40, 2:29:43]: About thirteen years ago when they had that rezoned. [2:29:43, 2:29:45]: It was uh Henry County. [2:29:45, 2:29:51]: Excuse me, sir, your name and address, please. Ma'am. Yes, another little Raymond King, one twelve Valley Dale Drive. [2:29:52, 2:29:57]: Right in their backyard. It was uh Henry County. We came down here. [2:29:57, 2:29:59]: The county rezoned it. [2:29:59, 2:30:00]: For the church. [2:30:01, 2:30:02]: The church. [2:30:03, 2:30:06]: They put in all the stipulations a privacy fence. [2:30:06, 2:30:09]: Paving the road, landscaping the whole nine yards. [2:30:09, 2:30:10]: For the church. [2:30:11, 2:30:12]: Nothing happened. [2:30:12, 2:30:14]: We call the county every year or so. [2:30:15, 2:30:20]: Но чайжес, но чангес, но чайжес фор. [2:30:20, 2:30:22]: We finally called them. [2:30:22, 2:30:24]: Several years ago, they said [2:30:25, 2:30:31]: Their rezoning is null and void because it's been a year and a half, they haven't done anything for the church. [2:30:32, 2:30:36]: This thing is five and a half years ago when they planned on uh [2:30:37, 2:30:38]: Building the town homes. [2:30:39, 2:30:40]: They knew it. [2:30:40, 2:30:42]: We knew three weeks ago. [2:30:42, 2:30:47]: when we got something in the mail that they wanted to put town homes in there. They knew [2:30:48, 2:30:50]: We had three weeks. [2:30:51, 2:30:52]: Three weeks. [2:30:53, 2:31:00]: And the whole time that Lance been sent back there, the word townhomes has never been brought up one time, not once. [2:31:02, 2:31:06]: А не оливод, ви щодо в кноп. [2:31:06, 2:31:10]: They've known this is five this plant right here is five and a half years old. [2:31:12, 2:31:16]: I don't even know if it's the correct one or not, if this is the most current one that they gave you. [2:31:17, 2:31:18]: But [2:31:18, 2:31:23]: We hadn't even had we've looked and saw saw the difference between twenty five feet variance and fifty feet. [2:31:24, 2:31:26]: And it's gonna raise the value of our house. [2:31:27, 2:31:30]: Anyway, we appreciate you guys' time. Thank you. [2:31:35, 2:31:36]: comment section. [2:31:37, 2:31:38]: Okay. [2:31:40, 2:31:42]: You need to take all that. [2:31:46, 2:31:47]: Yeah. [2:31:58, 2:32:13]: Let me ask um just a question for you. Um this the the one that we're voting on now is just for the church and then the next one is for the townhouses. That's correct. Yes, this is just the conditional use for the church itself. Okay. [2:32:20, 2:32:27]: Yeah. You do. Go ahead. Go ahead. [2:32:29, 2:32:30]: What it [2:32:31, 2:32:37]: Think he was trying to say something. I don't know if he can still say something. He was wanting to say something. The minister was wanting to say something. Is it over or? [2:32:39, 2:32:41]: Yeah, wouldn't I? [2:32:42, 2:32:50]: Okay. May I have a motion for item ten, conditional use permit? [2:32:51, 2:32:53]: I make a motion um [2:32:54, 2:33:01]: For the conditional use permit uh for the the place of worship at seven thirteen Valley Hero Road with the two um [2:33:01, 2:33:12]: conditions um to clear the area um that had the overgrowth and to meet with the residents before the um the next uh city council meeting on the twelfth. [2:33:15, 2:33:16]: Yeah, second. [2:33:18, 2:33:18]: Okay. [2:33:19, 2:33:20]: Go ahead. Yes. [2:33:23, 2:33:31]: Conditions that are already um proposed by staff with the additional two that you're adding? Yes. And um and I want to also include the [2:33:31, 2:33:33]: the conditions that the staff um [2:33:34, 2:33:39]: Recommended as well. So there will be a total of five conditions. [2:33:40, 2:33:40]: Thank you. [2:33:42, 2:34:00]: And I have a second from Mr. Doomis. I second, yes. It's been moved and seconded. All those in favor, let it be known by the soye. Aye. Those opposed? Ayes have it. The amendment is uh approved with the stipulated conditions. [2:34:01, 2:34:18]: Um item eleven, comprehensive plan amendment case number CP 2023-01. Consideration for requests for a comprehensive plan amendment to assign future land use designation of the of high density residential to parcel 029. [2:34:19, 2:34:26]: Uh zero one zero zero nine zero zero one on Valley Hill Road to allow for the construction of a townhouse development. [2:34:26, 2:34:30]: The applicant is Victory Wishop Center, represented by Keith G. Nation. [2:34:31, 2:34:39]: The property is located in Land Lide 103, District 12, and it contains 7.864 plus or minus acres in Stockbridge, city limits. [2:34:42, 2:35:02]: Uh yes, I'd like to clarify that of the two parcels, the conditional use permit was for the eastern parcel only, uh seven thirteen Valley Hill Road. Um now we're going to these these next three cases are exclusively for the western uh parcel. Um [2:35:01, 2:35:21]: And that is parcel number 029, hyphen 0100-9001. The applicant needed to separate the two parcels or have two separate parcels for a couple of reasons. One, the um for federal tax. [2:35:21, 2:35:37]: Tax purposes, um a church cannot receive tax uh um exemption if there are other types of uses on the property other than residential. So could not have the townhomes on the same property. [2:35:39, 2:35:40]: Um [2:35:41, 2:35:46]: And also the um townhomes portion needed to be rezoned. [2:35:46, 2:35:51]: um to appropriate use so could not be on the keep the same zoning. [2:35:52, 2:36:01]: So now I'm gonna talk with in this case and the next two uh about the town home proposal. Uh we've covered a lot of this material already. Um [2:36:04, 2:36:07]: Let me scroll down here. So [2:36:08, 2:36:13]: The applicant is seeking to rezone the property uh or to assign [2:36:13, 2:36:16]: to assign the um [2:36:17, 2:36:21]: Well, to rezone, but actually this case right now is for the comprehensive plan amendment. [2:36:22, 2:36:22]: Um [2:36:23, 2:36:27]: Applicant is seeking the high density residential category. [2:36:27, 2:36:32]: Now the category of high density residential is a little bit misleading. [2:36:33, 2:36:52]: The way that our current comprehensive plan is set up, anything that is more than three point six units per acre automatically gets put into the high density residential category. So applicant proposes to build uh seven point one two acres uh units per acre. [2:36:59, 2:37:00]: Okay. [2:37:01, 2:37:12]: So I've covered a lot of this about the the details of the development. Again, it's gonna be fifty-six um units. Property has about seven and a half acres. [2:37:16, 2:37:21]: So we looked at the the consistency with the comprehensive plan and we feel that it [2:37:21, 2:37:24]: High density residential would be consistent. [2:37:24, 2:37:28]: uh because town home development is a permissible use [2:37:28, 2:37:29]: And [2:37:29, 2:37:35]: Uh multifamily is also identified as being compatible on page forty five of the comprehensive plan. [2:37:36, 2:37:50]: The seven point one two units per acre is an allowable density range. The high density of six units to sixteen units per acre, that's high density residential. So this falls within that range. [2:37:51, 2:37:56]: Um as I mentioned before we had at the last council meeting um [2:37:57, 2:38:04]: Approval for another town home development to the south at five seven six uh Davis Davis Road. [2:38:04, 2:38:08]: for multifamily and high density residential. [2:38:11, 2:38:31]: The Comprehensive Plan Amendment would do a few other things. It would promote housing policies identified by the comprehensive plan, offering a variety of housing choices, mixture of housing options to attract young professionals and singles to the area, preserve older enhanced neighborhoods, promote rehabilitation. [2:38:31, 2:38:36]: of existing housing stock and revitalize established neighborhoods. [2:38:36, 2:38:40]: Um we feel that the location would be suitable. [2:38:40, 2:38:43]: Uh it's a reasonable size. It's on a major collector road. [2:38:44, 2:38:49]: And um I mentioned the other development on Davis Road already approved. [2:38:49, 2:38:59]: Although the subject property could be used for low density residential use, there's been little interest in that in recent years, so it's unknown whether there's any [2:38:59, 2:39:03]: um, demand for that type of use at this time. [2:39:03, 2:39:06]: Uh staff recommends that this uh be approved. [2:39:07, 2:39:09]: And approve with a condition. [2:39:09, 2:39:16]: um that the uh rezoning that's to come next also uh be approved at the same time. [2:39:30, 2:39:32]: Applicant like to speak on that. [2:39:36, 2:39:37]: Alles half om daar. [2:39:37, 2:39:40]: I think I've said that. [2:39:46, 2:39:47]: A comment from [2:39:51, 2:39:52]: I have a motion. [2:39:54, 2:39:56]: Yeah, maybe we're ready to open it up before we uh [2:39:59, 2:40:05]: Sorry about that. Um public comment. Those support or oppose this, um [2:40:06, 2:40:06]: Amendment. [2:40:09, 2:40:13]: We have anybody who supports or oppose the amendment from the public. [2:40:17, 2:40:20]: Hearing none, the public comment is the section is closed. [2:40:25, 2:40:26]: We have to move it. [2:40:27, 2:40:34]: I just wanted to ask a question. Can um can we put this that one of the conditions is that it has to have an HOA? Can you do that? [2:40:38, 2:40:54]: I don't know if that's we can't do that. Let me let me say this. If it's if it's if it's a sort of thing you have to have major first, you gotta have somebody to manage the public aspect of the property. So he hadn't said that. He said he done town of it. [2:40:54, 2:40:54]: Mm-hmm. [2:40:55, 2:41:04]: So I maybe I'm gonna need some changes. So Okay, you're saying we can't Okay. She said legally we can't do that. She said leg [2:41:06, 2:41:07]: What [2:41:09, 2:41:29]: D what was the answer? I I can barely see you. So we can't necessarily require a homeowners association. Um we can ask the applicant if they're going to utilize either fee simple. We can get a e a final answer on whether they're going to be fee simple. [2:41:29, 2:41:33]: town homes or if they're going to be for rent? [2:41:33, 2:41:52]: That's if if that's the question. And and say that one more time. Can you get right up to the I said that you can ask the applicant whether the properties are going to be for as fee simple townhomes, which means they will be on a for sale basis or for rent. Okay. But we could not stipulate that in the zoning condition. Okay. [2:41:56, 2:42:04]: She standed up. [2:42:10, 2:42:18]: Is our um public hearing still open at this time or are we closed? We are closed. I think she should go ahead and speak. [2:42:18, 2:42:21]: I didn't know it was closed. [2:42:21, 2:42:31]: I didn't know it was closed. I just have a question. That's all right. I I was wondering if what we had said uh previously about the church with all the concerns that we had about the um [2:42:31, 2:42:37]: buffering and the s in the road, you know, being a potential accident. [2:42:37, 2:42:48]: um zone. Um can those things be put onto this one or do we need to express our concerns for each individual thing that's um addressed? [2:42:49, 2:42:53]: Лайк воде за вита вот the first one. [2:42:54, 2:42:57]: It applies to this. Do we have to say all that again for the next one? [2:42:57, 2:43:01]: No. Carried over. No? No, no, no more. I just wanted to make sure. [2:43:02, 2:43:03]: Yeah. [2:43:03, 2:43:06]: I just had one question for the um [2:43:06, 2:43:19]: the minister. Um you had made the comment earlier that um you found out that that's that's the only thing you could do was um use it for townhouses. Um I just wanted you to clarify the point that you had made. [2:43:20, 2:43:40]: Well, as I said earlier, we initially uh had considered building uh condos. But when we came to came into Stockbridge city limits, uh we were informed that based on the the the kind of zoning that we want to uh have, the best use. [2:43:39, 2:43:47]: zoning was the one that we're now applying for. And that's why we then opted to go with the townhouses. Okay then [2:43:49, 2:43:49]: Okay. [2:43:54, 2:43:55]: I have a motion. [2:43:57, 2:43:59]: I make your motion correct. [2:44:04, 2:44:06]: We are on [2:44:06, 2:44:12]: number of the micro? Correct. Okay. Um so I make a motion to move. [2:44:14, 2:44:20]: I make a motion to uh move forward with the high density residential to parcel zero two nine. [2:44:20, 2:44:24]: Dash zero one hundred nine zero zero one [2:44:25, 2:44:29]: excuse me, on Valley Hill Road, um to include the recommendations by the city. [2:44:29, 2:44:42]: And um to include the citizens' concerns um by having a meeting with the citizens before um the twelfth and um again to c uh c clear out any overgrowth in that area. [2:44:44, 2:44:45]: Yeah, second. [2:44:46, 2:44:48]: Move to flash on with the second. [2:44:49, 2:45:03]: It's been moved and second. All those in favor let it be known by the sign of aye. Aye. Aye. Those opposed? Aye. The ayes have it and the uh uh amendment will go forward with the conditions stipulated. [2:45:06, 2:45:26]: If I may, um Chairman, the conditions are typically um this is for the comprehensive plan, so we can add those conditions if you're more comfortable on the rezoning that's coming next. Um instead of on the comprehensive plan amendment. Okay. So we need to amend the motion to uh exclude the [2:45:26, 2:45:30]: Conditions and apply them to the um [2:45:31, 2:45:51]: Okay, so I'll amend the motion to exclude the condition so that we can apply them to the next one. To the rezoning. So then there is one condition for this one, and it just states that the applicants requested rezoning of the subject property to assign to multiple family residential zoning district to the subject property via RZ. [2:45:51, 2:46:03]: C das two zero two three dash zero one is approved before or simultaneously with the approval of CP dash two oh two three dash zero one. That was the condition that came with the report. [2:46:06, 2:46:16]: Okay. So do we need to do it all over? Okay. So I make amen an amendment um to move forward with the high density residential to the parcel zero two nine. [2:46:16, 2:46:25]: zero one hundred nine zero zero one on Valley Hill Road to include the um the condition with that the city has recommended. [2:46:32, 2:46:39]: We moved to a second by Mrs. I I think we've approved it already with those amendments. Okay. [2:46:39, 2:46:43]: Item twelve, rezoning case number RZ two zero two three. [2:46:46, 2:46:51]: Yes we do, yeah, Mr. Plachard. It's an amended motion, so we'll need to have a second and then a vote. [2:46:53, 2:46:58]: Um motion has been made by um [2:47:00, 2:47:11]: Ms. Nelson. Kathleen. Uh Nelson. The second as um with the amendments. Mr. Plachan. [2:47:13, 2:47:33]: Mr. Boshan seconds. It's been moved and seconded. All those in favor, let it be known by the sign of aye. Aye. Those opposed, ayes have it. The amendment is carried. Um We have a three-one vote, it appears? No. Right. I stand aye for those. Okay, so oh we have a four okay to vote. No, no. I oppose. [2:47:33, 2:47:41]: Opposed. So we have to oppose it three one versus one. Three one. Thank you. With uh Mr. Dumas as a um opposer. [2:47:48, 2:47:50]: Go on to item. [2:47:50, 2:47:51]: Well [2:47:57, 2:48:17]: Rezoning case number RZ2023-1. Consideration of a request for rezoning to assign the multifamily residential zoning district to parcel number 029-01009001 on Valley Hill Road to allow for the consideration of a town. [2:48:17, 2:48:23]: House Development. The applicant is Victory Worship Center, represented by Keith G. Nation. [2:48:23, 2:48:29]: The property is located in land lot one hundred three district twelve and it contains seven point one eight [2:48:29, 2:48:32]: Seven point eight six four plus or minus acres. [2:48:33, 2:48:35]: within the Stockbridge city limits. [2:48:38, 2:48:53]: This is a proposed zoning to the MFR district multifamily residential. The current zoning of the property uh does not allow townhomes, thus the necessity to apply for the rezoning. Um [2:48:55, 2:49:05]: So part of the analysis for the rezoning is there are nine criteria, one of which is consistency with the comprehensive plan. I've actually just [2:49:05, 2:49:06]: Uh covered most of that. [2:49:07, 2:49:16]: It has appropriate uh townhomes are appropriate or permissible use under the MFR uh zoning as well as the comprehensive plan. [2:49:16, 2:49:20]: uh designation of high density residential [2:49:20, 2:49:31]: Um we discussed the density already and the fact that this would be compatible with um compar comprehensive plans. Um [2:49:31, 2:49:34]: Recommendations on housing goals and policies. [2:49:37, 2:49:51]: Um as far as carrying out the ability purpose and ability of this zoning code, um MFR districts should be located on collector or arterial streets and Valley Hill Road is classified as a major collect collector street. [2:49:52, 2:49:54]: positive effects on the area. Um [2:49:54, 2:49:58]: This would offer alternative type of housing, carrying out the [2:49:58, 2:50:02]: Comprehensive plan goal of encouraging higher density development. [2:50:02, 2:50:03]: Um [2:50:04, 2:50:05]: And [2:50:06, 2:50:09]: The site would be фізико фізикally suitable. [2:50:09, 2:50:23]: Uh no accesses would be provided to or from adjacent properties and adequate buffering would be uh provided, so therefore there should not be many adverse eva impacts on adjacent properties. [2:50:24, 2:50:44]: As far as utility impacts on water and sewer infrastructure, the applicant submitted a letter from obtained a letter from Clayton County Water Authority. There is a 24-inch water main and an eight-inch sanitary sewer main along Valley Hill Road and Project Wayne. [2:50:44, 2:50:51]: Wastewater would be treated at the North East Clayton facility, um, basically right across the street. [2:50:51, 2:50:59]: uh the developer though would have to construct all water and sewage facilities um and extensions to meet the authorities standards. [2:51:03, 2:51:12]: impacts on traffic. Um there's not been a big this is a small development, so traffic study was n not uh completed. Um [2:51:13, 2:51:23]: The s site could be developed as it's currently zoned, but again, w there's not been any interest shown in that uh type of development in recent years. [2:51:24, 2:51:28]: We conclude that the proposed uh rezoning would be acceptable. [2:51:29, 2:51:49]: The condition upon approval of a comprehensive plan amendment, which you just recommended approval for, and the variance case coming next to be discussed, and the site plan that was submitted, or a very similar one. So those are the three conditions recommended for approval. [2:51:48, 2:51:49]: Approval. [2:51:55, 2:51:57]: Applicant have any comments? [2:52:01, 2:52:02]: Public [2:52:03, 2:52:04]: Those in support. [2:52:05, 2:52:07]: Those opposed. [2:52:08, 2:52:09]: I've got one. [2:52:09, 2:52:12]: Quick. Can we still s [2:52:15, 2:52:35]: Just real quick and this is all I got to say. Nobody said anything about the gas compression station right across the street from them. We just went to Williams. There's a uh natural gas uh compressor station right across the street from where they wanted to build the townhomes. We went met with Williams the other day, they upgrading it. [2:52:35, 2:52:40]: They put more compressors in there. They said there may be a little bit more [2:52:40, 2:52:44]: Noise and vibrations. So when they build their town homes. [2:52:46, 2:52:48]: And the the town homes are vibrating. [2:52:49, 2:52:51]: You can't hear yourself think. [2:52:52, 2:52:56]: We live farther away from them, and I'm sure our house is built a lot better than these town homes are gonna be. [2:52:57, 2:52:58]: But when those people move in [2:52:59, 2:53:01]: And their house is vibrating. [2:53:01, 2:53:02]: Ours vibrates. [2:53:02, 2:53:05]: There's just gonna be right across when their house is vibrating. [2:53:06, 2:53:09]: And they can't hear their self think or watch T V and hear the T V without [2:53:10, 2:53:11]: Doing this. [2:53:11, 2:53:13]: I hope they go over there and they can talk to them, say [2:53:14, 2:53:15]: How did y'all let this happen? [2:53:16, 2:53:20]: And y'all zoning people said, Well the people moving in there should do uh due diligence. [2:53:20, 2:53:21]: And check it out. [2:53:22, 2:53:24]: And make sure you know what's over here. [2:53:25, 2:53:27]: Most people are not gonna do that. [2:53:28, 2:53:28]: Until. [2:53:29, 2:53:33]: And I hope the people that are building these townhomes are there to answer. [2:53:34, 2:53:35]: to the people that do move in. [2:53:36, 2:53:38]: Uh, because I'm I probably won't be living there. [2:53:39, 2:53:41]: But I'm gonna come to them and say we brought this up to them. [2:53:42, 2:53:44]: The gas plant was there first. [2:53:44, 2:53:47]: When your house is vibrating and you can't hear yourself think. [2:53:48, 2:53:49]: We just met with them. [2:53:50, 2:53:53]: We just met with them and they're fixing to increase it. [2:53:53, 2:53:54]: Ništa [2:53:55, 2:53:56]: It's gonna be terrible over there. [2:53:57, 2:54:00]: But that's a decision those people are gonna have to make when they buy those town homes. [2:54:01, 2:54:03]: But they gonna have to live with it. [2:54:03, 2:54:04]: Thank you. [2:54:08, 2:54:28]: I'm Richard Cook and I live at 312 Grove Hill. Uh and I do not live on the street that the uh townhouses are going back up to. But what I would wish is that before the decisions are made, that someone really goes out there. [2:54:28, 2:54:45]: and looks at Valley Hill. Earlier Donna was saying how the you know the hill you go up is hilly, it's it there's a hill and then there's a downhill, curve, and then another uphill. [2:54:46, 2:55:06]: And the only way you're gonna understand it is to actually go s look at it. I just don't see how one house, there was a one house driveway there. One house, that's probably okay. Even they're not safe. But I can I can't imagine a bunch of cars coming. [2:55:06, 2:55:26]: Coming out of there, there is no flat place. It's not a flat place like they're saying, it's a hill. And uh if you're going toward publics in Stockbridge and coming back, it's even more hills before you get to where they're wanting to do this driveway. [2:55:26, 2:55:46]: I'm just saying it's a very dangerous road there. People fly through there all the time. They start at the at the at the red light on uh up at the church that's there now, and they just zoom through there. And and I know [2:55:46, 2:56:06]: I know we have a better police force now, but you know you can't catch all of it. They'd like to go, they like to speed through there, go over those hills and that curve, and I don't tell you how many I've seen in the ditch at the bottom of that hill, that that that hill there. [2:56:06, 2:56:26]: in between. So I would just say that I would would hope that someone in charge of making decisions would go out there and examine that road before they make a decision. Or or maybe even put the driveway somewhere else, I don't know. [2:56:26, 2:56:28]: But there's not much of a place to put it. [2:56:29, 2:56:30]: That's all. [2:56:31, 2:56:33]: Thank you. You're welcome. [2:56:43, 2:56:44]: Where is he going? [2:56:48, 2:56:50]: Open for couple to public comment. [2:56:53, 2:56:54]: But it's [2:56:54, 2:56:57]: All those in support, opposed. [2:56:59, 2:57:02]: Hearing none, public comment is closed. [2:57:04, 2:57:05]: Have a motion. [2:57:15, 2:57:16]: Oh no, I mean. [2:57:22, 2:57:23]: Go ahead. [2:57:25, 2:57:36]: I'll go ahead and present a motion on rezoning case uh number RZ two zero two three dash zero one. [2:57:37, 2:57:40]: Consideration request for rezoning to signal. [2:57:40, 2:58:00]: The MFR Multifamily Residential Zoning District, parcel number 029-01009001 on Valley Hill Road to allow for construction of a town home development. [2:58:01, 2:58:21]: The applicant is a Victory Worship Center represented by Keith G Nation and the property is located in the land lot one oh three of District twelve and it's contains seven point eight six four plus or minus eight. [2:58:21, 2:58:25]: acreage within the city of Stockbridge City Limit. [2:58:26, 2:58:26]: Mm-hmm. [2:58:31, 2:58:32]: Is there a second? [2:58:33, 2:58:40]: I just wanted to clarify, do you mean um with the three conditions that the city had the city had three conditions on this? [2:58:40, 2:58:43]: What is the motion exactly? [2:58:43, 2:58:47]: To approve to approve and to deny the rezone case. [2:58:51, 2:58:55]: Number R Z two Zero Two Three Dash Zero One. [2:58:58, 2:59:00]: So the city had three conditions. [2:59:01, 2:59:08]: Yeah, the city has to be conditioned. You include you incorporate notes, correct? I I didn't incorporate'em. [2:59:14, 2:59:26]: The city has uh three conditions to that, that'd be comprehension plan amendment. Also uh the city has a variance and the city has site plan. [2:59:28, 2:59:45]: You want me to read'em all? No, no, you I just say this is include those very those conditions. And then the the meeting the meeting. I should then and the meeting that they're gonna have with the public. And then here we should say. Include the meeting that they're gonna have with the public. [2:59:45, 2:59:55]: Uh also including the meeting that uh they should have with the uh neighbors in the area where the property is gonna be developed. [2:59:56, 2:59:58]: And clean up the surrounding area. [2:59:59, 3:00:06]: And the surrounding areas. Cleaning up cutting the grass. Also cleaning up and cutting the grass on the property. [3:00:09, 3:00:10]: I second the motion. [3:00:11, 3:00:20]: Been moved and seconded. All those in favor let it be known by the sign of aye. Aye. Those opposed? Aye. Ayes have it. We got uh Mr. Dooms, are you explaining? [3:00:20, 3:00:28]: No. I said I I posed. You pose. Yes. Three to one. Audience yes. Three to one. Okay. [3:00:29, 3:00:35]: Item thirteen, variance case number VR two three dash one. [3:00:36, 3:00:39]: Consideration of a request for a variance for parcel zero two nine. [3:00:40, 3:00:46]: zero one zero zero nine zero zero one on Valley Hill Road to allow for this construction of a townhouse development. [3:00:46, 3:00:52]: The purpose of the variance is to allow the reduction of the front yard setbacks from the required fifty feet to twenty five feet. [3:00:53, 3:00:59]: In the uh multifamily residential zoning district. The property is located in the land lot one oh three on [3:00:59, 3:01:07]: Landlot 103 of District 12, and it contains 7.864 plus or minus acres within the Stockbridge city limits. [3:01:10, 3:01:28]: This is a re a variance request to purpose is to reduce the required front yard setbacks of the individual townhome units from fifty feet to twenty-five feet. Um [3:01:32, 3:01:35]: There are several uh criteria for consideration. [3:01:39, 3:01:46]: So there's set seven requ required criteria from section ten point one point two of the Unified Development Code. [3:01:47, 3:02:04]: So criterion A, whether the subject property has extraordinary and exceptional physical characteristics compared to other properties of the same uh zoning district. So I mentioned before unbuildable area at the front of the property where they it's a low area and that's where they're gonna put a detention pond that um [3:02:05, 3:02:25]: Uh limit some of the area of the property that they could build on, so they've had to make make the lot smaller to accommodate that and to create a reasonable site plan. Criterion B: whether literal interpretation of UDC would deprive applicant of rights that are commonly enjoyed by owners of other properties. [3:02:25, 3:02:38]: properties the same district, uh yes, the applicant uh may be deprived of that ability uh to have lots that are similar size to those of others that are found in other MFR districts. [3:02:42, 3:02:50]: Criterion C whether requested variants would give a property owner any special privileges that are denied to other property owners in the same zoning district. [3:02:51, 3:02:54]: No special privileges would be given to the property owner. [3:02:54, 3:02:55]: And [3:02:55, 3:02:59]: The denial of the variants would force the developer to comply with the standards. [3:02:59, 3:03:02]: Which would create an unfair, necessary hardship. [3:03:02, 3:03:04]: Uh due to the properties [3:03:04, 3:03:07]: difficult physical characteristics. [3:03:07, 3:03:11]: Criterion D whether variants would be consistent with the purposes and intent of the UDC. [3:03:12, 3:03:25]: uh whether it be compatible with neighboring uses and whether it would serve the public interest variants would be consistent with the purpose of the UT UDC by encouraging the most appropriate use of land and buildings on the subject property. [3:03:27, 3:03:34]: Um, the variants would allow development of a property in a mostly residential area, which has had little development activity in recent years. [3:03:35, 3:03:39]: And it would be compatible with other existing residential uses in the area. [3:03:40, 3:03:50]: Criterion E, whether extraordinary circumstances are not a result of the actions of the applicant, well no, the physical conditions of the property are not created by the applicant. [3:03:50, 3:03:55]: yet they're limiting the applicant's ability to develop the property into a reasonable use. [3:03:59, 3:04:05]: Criterion F whether the variance is the minimum relief that would allow the legal use of land [3:04:06, 3:04:14]: uh as I said before, developer could build still build a townhome development without the variance, but would be cons significantly constrained. [3:04:15, 3:04:17]: In doing so, creating a site plan. [3:04:17, 3:04:21]: to allow sufficient number of units to be economically feasible. [3:04:21, 3:04:35]: Criterion G, the variance is not a request to permit a use of land, buildings, or structures such as prohibited in this zoning district. Townhomes are a permitted use within the proposed MFR district. [3:04:36, 3:04:38]: Staff concludes that this [3:04:38, 3:04:41]: Variant's request would be reasonable and acceptable and [3:04:41, 3:04:54]: And therefore recommends uh approval with conditions again based on the previous uh approvals of the previous cases, the comprehensive plan amendment, the rezoning, as well as the site plan that has been presented. [3:05:01, 3:05:03]: Comments from the applicant. [3:05:05, 3:05:05]: I'm sorry. [3:05:09, 3:05:11]: No comment? No comment. [3:05:12, 3:05:14]: Right, open up for public comment. [3:05:15, 3:05:22]: Those in support. Pardon me? Okay, no problem, no problem. [3:05:24, 3:05:25]: Pardon me? [3:05:31, 3:05:33]: Yeah, it's a front yard. [3:05:35, 3:05:55]: It it would be uh internally with the lots uh on the interior interior of the property. The applicant wants to build a looped street on the interior and then the town home units would be uh facing that street and so um so the setbacks would be reduced from [3:05:54, 3:05:58]: From the interior street, not from the outside of the property. [3:06:03, 3:06:18]: I'm sorry, for for anyone speaking in public hearing, point of order, we need to have people either come to the mic or direct the questions um either to to the council or the planning commission at this time, um, so that we can understand and keep it for the record if you don't mind. [3:06:18, 3:06:19]: Thank you. [3:06:23, 3:06:32]: So if we're opening up for public hearing, then this would be that time if the council if the commission is willing to do that at this time. [3:06:32, 3:06:34]: Open it up for public comment. [3:06:35, 3:06:47]: What what is the distance between the townhouses and the the houses on Valley Hill, the back of their houses? What is the footage between you have any idea what that is? [3:06:53, 3:06:55]: The footage between [3:06:57, 3:07:01]: Are you speaking of the west side of the property? The rear the rears of the property? [3:07:02, 3:07:07]: The house the houses that are on the street on Valley Dale. [3:07:09, 3:07:25]: The townhouses are backing up to those houses. How much distance is between those houses backyard and the back yard of those townhouses? It's fifty feet. I'm looking at the site plan here. [3:07:35, 3:07:38]: Sir, please state your name and address for the record, please. [3:07:39, 3:07:57]: My name is Oji I'm Degu, I'm the architect of this uh property. Uh you are asking a question about that distance. Can you come over here? No, no, no, no, let's answer the question. You don't have to you know Oh, it's fifty feet from the from the property line to the area of the townhouse. [3:07:58, 3:08:13]: fifty feet yeah to the backyards. Correct correct. The townhouses, the backyard to the back townhouses. Yeah. That's a great provision. Yes. [3:08:13, 3:08:19]: Yeah, they g they have to be a fence on the property lines. Are you live do you live on the opposite side? [3:08:20, 3:08:20]: Yeah. [3:08:22, 3:08:42]: So it has nothing to impact your own facility. Yeah. It will only affect the people within this side of the property. From their own property line is fifty feet. That's along a very distant space. Okay. Okay? Okay. All right. Any other question? [3:08:42, 3:08:43]: No. [3:08:43, 3:08:44]: Thank you. [3:08:50, 3:09:07]: I believe it doesn't. Chairman, can I take time? Go ahead. Go ahead. I just wanted to strongly encourage the public um when they set up the meeting to let your neighbors know and just, you know, bring all your your concerns and if you want them to explain anything or go over anything, I think that'd be a really good time to just get all your questions and concerns answered. [3:09:10, 3:09:14]: That being the case, I think at this point public comment is closed. [3:09:18, 3:09:19]: Uh entertain a motion. [3:09:20, 3:09:31]: Mr. Chairman, this is Dave Planchon. I'd like to make a motion that we accept the variance and all of the conditions have already been met. So And I and Harold will second it. [3:09:33, 3:09:40]: Alright, this has been moved in second. All those in favor let it be known by the sign of aye. Aye. Those opposed? Aye. [3:09:41, 3:09:41]: Three to one. [3:09:43, 3:09:52]: Three to one. We have one uh post. Okay. Next item on the agenda is project update. [3:09:53, 3:09:55]: There are no project updates tonight. Yes. [3:09:58, 3:10:00]: Staff comments. [3:10:01, 3:10:03]: Chairman, there are no um additional staff comments. [3:10:04, 3:10:06]: Board comics. [3:10:10, 3:10:13]: There appears to be no board comments, motion to adjourn. [3:10:13, 3:10:33]: I make a motion to adjourn tonight's meeting. Been moved and second. All those in favor let it be known by the sign of aye. Aye. Those opposed? You're not abstaining. Ayes have it. [3:10:33, 3:10:35]: Yeah, yeah, yeah.
