The purpose is to allow for the construction of a missed [0:06:10, 0:06:30]: Residential development with townhomes and single-family detached homes. The property owner is William K. Excuse me if I said your name incorrectly. And the property owner of 1468 are the same. The applicant is Land Buyers of America LLC. The agent is Michael Kahner. The property is located in landlots 11. [0:06:30, 0:06:35]: and twelve of district six and contains twenty one point seven more or less acres. [0:07:16, 0:07:21]: Located in Council District five. After the property is annexed into the city, the property's current [0:07:21, 0:07:41]: Henry County Zoning District is RA, Residential Agricultural, and the applicant requests that the property be assigned to the City of Stockbridge Zoning District of PUD Planned Unit Development. The purpose is to allow for the construction of a mixed residential development with townhomes and single family, which contains 21.7 more or less acres. The staff will now give a joint pre- [0:07:41, 0:07:45]: Presentation of all three cases. Please staff. [0:08:30, 0:08:39]: Good evening, everyone. This is a PowerPoint presentation for property at 1448 and 1468 Flippin' Road for three cases. [0:08:39, 0:08:46]: Um AX twenty twenty five oh one, C P twenty twenty five oh one and R Z twenty twenty five oh one. [0:08:53, 0:09:06]: So I'm gonna discuss probably first give the overview of the proposed project and then get into the analysis for each one of the three cases. Um so the purposes of the cases, the property description, and the proposed development. [0:09:07, 0:09:24]: Um the purpose of annexation case AX twenty twenty-five oh one is to annex property from unincorporated Henry County to the Stockwood City limits and purpose of comprehensive plan amendment case number CP twenty twenty-five oh one is to change the property's future land use designation. [0:09:25, 0:09:31]: From Henry County's residential suburban to City of Stockbridge's resid medium density residential. [0:09:31, 0:09:34]: And then for rezoning case number R Z twenty twenty five oh one. [0:09:34, 0:09:38]: Its purpose is to change a property's zoning district from Henry County's R A [0:09:39, 0:09:43]: Residential Agricultural Zoning District to the City of Stockbridge's [0:09:43, 0:09:48]: PUD Plan Unit Development District, the applicants, land buyers of America L L C [0:09:48, 0:09:49]: Agent Michael Kahner. [0:09:50, 0:09:51]: Um and [0:09:51, 0:10:03]: Now the annexation case must be approved uh before the other two cases can can be approved. Here is a joint aerial photo. There are two parcels side by side in Flippin' Road just south of [0:10:03, 0:10:05]: I seventy five. [0:10:06, 0:10:07]: And then um [0:10:07, 0:10:14]: The first one, fourteen forty eight, there's some floodplain areas around there. A little bit of it touches on the corner of this parcel. [0:10:19, 0:10:33]: Uh we mentioned already the property owners, twenty seven point seven seven one total acres roughly. This is located on the west side of Flippin Flippin' Road, south of Surge Stone Lane, and across from the St. Ives Court. Excuse me. [0:10:34, 0:10:40]: Uh the property's mostly wooded, except for a single family home on each parcel. [0:10:40, 0:10:41]: Um [0:10:41, 0:10:48]: The future land use designation residential suburban by Henry County and current zoning RA by Henry County. [0:10:50, 0:10:53]: Let's see, we have some additional information here. Some of this is [0:10:53, 0:10:55]: been mentioned already? [0:10:55, 0:11:00]: surrounding zoning, we have suburban and residential to the north in the city. [0:11:00, 0:11:05]: uh rural agriculture to the west, single family residence uh to the southwest. [0:11:06, 0:11:08]: Rural agricultural and multifamily to the south. [0:11:09, 0:11:17]: Residential duplex, Henry County to the southeast, and suburban residential and PUD to the east. Um [0:11:21, 0:11:24]: Okay, here's a joint future land use map. [0:11:24, 0:11:27]: Of the property shown by the two stars. [0:11:29, 0:11:31]: Uh joint zoning map. [0:11:32, 0:11:36]: Here is the survey of the property. There is a house on each parcel right now. [0:11:37, 0:11:44]: All right, the proposed development uh developer proposes a mixed residential subdivision to be called Hanover Park. [0:11:45, 0:11:50]: It would contain thirty one single family detached units and a hundred twenty [0:11:50, 0:11:51]: Town home units. [0:11:51, 0:11:54]: Uh for a total of a hundred and fifty one units. [0:11:54, 0:11:57]: Density would be six point nine four units per acre. [0:11:58, 0:12:15]: They're proposing PUD. Uh that's necessary because they're including two types of residential uses. Otherwise, if it was just one, it would be MFR. All units will have three bedrooms, two baths, two car garages. And homes would have sixteen hundred to two thousand square feet. [0:12:15, 0:12:25]: and be covered by brick and hardyboard uh facades. Uh there are quite a few uh amenities being proposed, a pool with a clubhouse, golf putting green, tot lot, [0:12:26, 0:12:35]: tennis or t pickleball courts and a community sports field. Um they've prepared a colored site plan and a black and white sub plan uh site plan. [0:12:35, 0:12:36]: Um [0:12:36, 0:12:40]: And the title is Annexation and rezoning plan for H Hanover Park. [0:12:43, 0:12:44]: Let's see if we can get to the [0:12:46, 0:12:55]: Here's the colored site plan. And this is Flippin' Road on the east on the on the east side. So it would have two entrances off of Flippin' Road. [0:12:55, 0:13:03]: uh circular driveway around. There would be a clubhouse and a pool at the front with some guest parking. [0:13:03, 0:13:11]: uh pickleball or tennis courts in the center, a community sports field, and uh golf pudding green in the taut lot. [0:13:12, 0:13:19]: And n they would have the single family homes mainly on the north side here, around to the back. [0:13:20, 0:13:28]: Um and then the town homes would be more i in the in the center and then down on the south side. And there'd be one large house here at the front. [0:13:30, 0:13:31]: Here's an enlargement of that. [0:13:34, 0:13:41]: The black and white site plan so shows further details. Um the the the lot individual lots are numbered. [0:13:41, 0:13:42]: And so forth. [0:13:44, 0:13:50]: There is some uh wetlands down in this corner. Let me go back to this other slide here. [0:13:53, 0:13:54]: Um [0:13:56, 0:14:02]: So I mentioned all this. There'd be a twenty five foot uh buffer around the property. Um [0:14:06, 0:14:18]: Setbacks twenty feet in the front yards for all units, five feet in the side yards for single family lots, uh zero feet on the for on the side for town home lots, and twenty feet in the rear yards for all lots. [0:14:19, 0:14:24]: Now these setbarks are not required because they're rezoning the PUD, but this is just what they proposed. [0:14:25, 0:14:27]: Distance between town home buildings twenty feet. [0:14:27, 0:14:28]: Um [0:14:32, 0:14:32]: Okay. [0:14:34, 0:14:37]: This is just a table with all that same information. [0:14:43, 0:14:47]: Okay. This is an analysis of the annexation case. [0:14:51, 0:15:03]: So there were several questions to to be answered. Uh mainly is the property contiguous to um a property that's already in the city and yes it would be. Uh several parcels. [0:15:03, 0:15:06]: Next to uh Saint Ives Court. [0:15:06, 0:15:09]: And another parcel next to Rum Creek subdivision. [0:15:09, 0:15:12]: The hundred percent annexation method will be used. [0:15:12, 0:15:13]: Um [0:15:14, 0:15:17]: And the property would be within Henry County boundary. [0:15:20, 0:15:28]: The property is receiving mun municipal services from Henry County, um, the Water Authority, Henry County Fire and EMS, also Georgia Power. [0:15:30, 0:15:34]: And the properties that would be used for urban purposes would be developed. [0:15:34, 0:15:36]: With a proposed development. [0:15:37, 0:15:40]: Um they've also applied for comprehensive plan. [0:15:40, 0:15:41]: Amendment? [0:15:44, 0:15:53]: This would help to further one of the goals of the comprehensive plan by providing new additional housing into the city, providing options with different types of housing. [0:15:54, 0:15:54]: Um [0:15:56, 0:15:58]: The site seems to be suitable. [0:16:01, 0:16:02]: Okay. [0:16:06, 0:16:09]: All right, we recommend approval of the annexation case. [0:16:10, 0:16:13]: Now here's analysis of the comprehensive plan amendment case. [0:16:14, 0:16:16]: So the request is to [0:16:16, 0:16:20]: A sign after property's annexed into the city if that happens. [0:16:21, 0:16:25]: Uh request is assigned a future land use designation of medium density residential [0:16:26, 0:16:28]: To allow the mixed residential development. [0:16:29, 0:16:39]: Medium density residential allows a density from four to seven point nine nine units, and this would be uh six point uh nine four units per acre. [0:16:43, 0:16:51]: We have some of the surrounding land use designations, low and medium density, uh f couple high density. [0:16:52, 0:16:52]: Um [0:16:53, 0:17:00]: This property would have a density of six point nine four units per acre. Flippin' wood town homes nearby would be similar to that. [0:17:02, 0:17:04]: And yeah, there's our single family. [0:17:05, 0:17:07]: These are some of the surrounding developments. [0:17:11, 0:17:20]: Uh so as I said, this will meet the housing goal of the comprehensive plan, make adequate uh facilities and services available to city residents. [0:17:21, 0:17:24]: And have appropriate land use designations. [0:17:30, 0:17:31]: They [0:17:32, 0:17:37]: relation to the zoning of the uh surrounding property would be compatible with other surrounding la land use designations? [0:17:38, 0:17:41]: Uh, which includes single family and town home developments. [0:17:44, 0:17:49]: And there would be there's other s medium density residential designations in the area. [0:17:50, 0:17:51]: Okay. [0:17:52, 0:17:59]: We recommend approval of CP twenty twenty five oh one. Now the analysis for the rezoning case are Z twenty twenty five oh one. [0:18:01, 0:18:04]: There's certain standards that have to be met, consistency with the comprehensive plan. [0:18:05, 0:18:06]: Which I've covered. [0:18:11, 0:18:15]: I mentioned that it needs to be PUD because two types of land uses would be included. [0:18:17, 0:18:24]: Uh this would be an extension of another PUD uh zoning district on the other side of Flippin' Road. [0:18:24, 0:18:27]: There would be a number of amenities included in the project. [0:18:28, 0:18:30]: Property's fairly flat right now. [0:18:32, 0:18:35]: It seems suitable for the development of of the property. [0:18:36, 0:18:38]: You don't participate. [0:18:38, 0:18:42]: Um adverse impacts on surrounding uh properties. [0:18:45, 0:18:54]: The applicant obtained a water authority, a letter from Henry County Water Authority, which stated that water and sewer services are available to serve proposed development. [0:18:54, 0:18:55]: Oh. [0:18:57, 0:19:02]: No traffic impact study was submitted. Uh we could not [0:19:03, 0:19:06]: Uh evaluate that impact as of yet. [0:19:07, 0:19:08]: There would be two [0:19:09, 0:19:17]: uh entrances to the property that would accommodate emergency vehicles. Deceleration lanes and sidewalks will be provided along Flip Flippin' Road. [0:19:22, 0:19:27]: Okay, uh we've concluded that the proposed re mixed residential development will be well suited to the site. [0:19:27, 0:19:29]: It would be attractive design. [0:19:29, 0:19:34]: It's good that they're having two site two accesses to the property for emergency vehicles. [0:19:35, 0:19:35]: Um [0:19:36, 0:19:38]: And they would have sufficient open space [0:19:38, 0:19:43]: Um the proposed density setbacks and distances would be reasonable. [0:19:44, 0:19:44]: Um [0:19:45, 0:19:59]: We actually calculated that they would provide uh well over the amount of parking that's needed. We recommend approval conditions uh based on the uh site plan that is similar to the one that was submitted, having um [0:20:00, 0:20:02]: Decelerations and project entrances. [0:20:02, 0:20:05]: Actually I mentioned that parking was actually sufficient. [0:20:06, 0:20:10]: An architectural design proposed home shall be constructed with styles of exterior materials. [0:20:11, 0:20:13]: Which comply with UDC standards. [0:20:13, 0:20:16]: And for property maintenance, uh HOA or property management. [0:20:17, 0:20:19]: Companies shall maintain the common areas. [0:20:19, 0:20:21]: of the property and the townhomes. [0:20:23, 0:20:24]: Any questions? [0:20:25, 0:20:27]: Thank you so much, Linda. Are there any questions for staff? [0:20:29, 0:20:39]: Mr. Chairman, I have a question. Please. Ms. Logan, so is there any um potential for a traffic impact study before this uh this moves forward? [0:20:40, 0:20:46]: Uh that would be a question to the applicant. Applicant is here tonight and is is gonna be making a presentation. Maybe you can answer that question. Thank you. [0:20:47, 0:20:57]: You have a question. I have one. Please. Mr. Logan, this development could it be accomplished without annexation? [0:21:00, 0:21:07]: Well, I don't know whether the applicant applied with Henry County or not. Um that was their option. [0:21:10, 0:21:15]: It looks from what I've seen on the plans, it looks very similar to [0:21:16, 0:21:34]: a subdivision development just north of that site where you have a combination of town homes and single family residential and s a few amenities. That particular project is located in Henry County. [0:21:35, 0:21:41]: I was just curious as to couldn't that same thing be done on this site without an annexation? [0:21:42, 0:21:43]: As po as possible. [0:21:45, 0:21:48]: But the applicants chosen to apply for annexation. [0:21:49, 0:21:50]: I understand that. [0:21:52, 0:21:55]: But the annexation [0:21:57, 0:21:59]: What further [0:22:00, 0:22:20]: Exacerbate what I've been widely hearing as to the balance of commercial versus residential property in the City's stock bridge. The burden is heavily skewed now toward residential property owners. Uh and and to continue to add. [0:22:20, 0:22:23]: add residential properties doesn't help that situation at all. [0:22:25, 0:22:33]: That's where I was going with the question. I'm not necessarily questioning the project itself, but does it need to be in Stark Bridge in order for it to happen? [0:22:34, 0:22:36]: That's for the council to decide. [0:22:38, 0:22:43]: I'm gonna echo your sentiments on that, Commissioner. But uh if there's any if there are no other questions. Can you hear me now? [0:22:44, 0:22:54]: Say it again. I said I'm gonna echo your sentiments because I I stand with that as well. But if there are no other questions for staff, I would like to hear from the applicant and allot those ten minutes to have our necessary questions. [0:22:56, 0:22:59]: If the applicant can please come up and say their name and address. [0:23:03, 0:23:03]: Thank you, Ms. Lynn. [0:23:38, 0:23:58]: Good afternoon, Planning Commission, staff, public. My name is Jonathan Jones and I'm with Elite Engineering. I represent land buyers of America for the proposed annexation and rezoning of about 22 acres located adjacent to the city. One of the questions obviously is could it be developed in Henry County? Um it probably could be developed in [0:23:58, 0:24:02]: [1443.0, 1452.0]: was searching for property that could was either in the city or could be annexed in the city. Um just to be honest with you, the city of Stockbridge has a better [0:24:13, 0:24:18]: persona marketability than Henry County in most parts and [0:24:18, 0:24:19]: We feel or they felt. [0:24:20, 0:24:28]: like it was a a a better product and a better project to be in the city. And that's solely the reason that we we went that route. Um [0:24:29, 0:24:30]: Де її [0:24:32, 0:24:34]: Get this thing so everybody can see it. [0:24:38, 0:24:39]: There it goes. [0:24:40, 0:24:42]: All right, let me see if I can't make this [0:24:43, 0:24:51]: Okay. Um so a couple things that we have done to try to uh differentiate this project. [0:24:51, 0:25:01]: um from adjacent properties and other projects that these these developers are doing is the amenities is going to be a restore a resort style amenity. [0:25:01, 0:25:21]: When you pull into development, the first thing you're gonna see is the clubhouse. It's gonna be a very nice clubhouse, it's gonna have a pool, it's gonna have putt putt greens that'll be weatherproof, it's gonna have um pickleball courts, it's gonna have a community playground right centralized in between um the community, it's gonna have sidewalks that walk [0:25:21, 0:25:41]: Walk all around the community and connect to the amenity itself. And there's a requirement for a 10-foot sidewalk along the entire frontage of Flippin' Road. So the investment alone in the amenity by this development group is g is gonna be quite s excessive. And that that alone should should, in my opinion, tell you that they're serious about wanting to. [0:25:41, 0:25:53]: to be here. They're serious about want to do a quality product here. They didn't come in with little cabana and a little bitty pool. They came in with a strategy of providing something that people want to live at. [0:25:54, 0:25:55]: Oh. [0:25:55, 0:25:56]: Um [0:25:56, 0:26:16]: It it is a mixed use, uh can considered a mixed use because there's single family homes and there's town homes and and we have uh tried to design the project so that the north and west um we build single family homes adjacent to single family homes um to limit the impact. We realize that no matter what. [0:26:16, 0:26:17]: Right. [0:26:17, 0:26:26]: Whether we develop this property or somebody else develops this property, it impacts the neighbors. We recognize that and we try to be conscious enough to [0:26:26, 0:26:46]: to to you know if if there's single family there then we want to we want to match it. We didn't we didn't try to put townhomes up against single family. We intentionally tried to differentiate. Another one of the concerns um was was access in and out. We're providing a parkway style entrance where it'll have a divided medium. It'll have two in, two out, and [0:26:46, 0:26:57]: We're going to provide a traffic study and if that traffic study warrants a light or a left turn lane, we're amenable to putting in those items. [0:26:58, 0:27:01]: A lot of people don't understand exactly about the light. [0:27:03, 0:27:12]: We can't put a light in because we want to and we can't put a light in because you want to. If it's warranted, then we're allowed to put it in. There's strict [0:27:12, 0:27:16]: requirements. Now I personally think with the traffic on this road, it will be warranted. [0:27:17, 0:27:18]: So but [0:27:19, 0:27:27]: Whether the county wanted to, the city wanted to, or a local developer wanted to, you just don't get to put a light in. It has to be warranted. So um [0:27:27, 0:27:35]: The proposal is 120 townhomes, 31 single family homes. The townhomes will be a mix of two story and three story. [0:27:35, 0:27:36]: Um [0:27:38, 0:27:44]: Staff did recommend approval um and and part of the the um comprehensive plan amendment [0:27:44, 0:27:51]: Um it it it denoted that this development would quote help the city in its needs for additional housing. [0:27:52, 0:28:07]: Um that's not something we created. That was something that staff noted. Um it is compatible with adjacent properties. There's some PUDs, there's some town homes, there's some duplexes. Um the open space we're providing is more than is required under the requirements. Um [0:28:08, 0:28:18]: The density allowed is from four to eight units per acre, so we fall within that. Um this project build out would not happen before the 75 connector is completed. [0:28:19, 0:28:39]: So I know part of the concerns is traffic and getting from point A to point B, but the intent would be that the 75 connector would be completed before the duration of this project. One thing that I did note from Miss Linda when she was talking, it said something about the houses 1600 to eight or to 2,000. The minimum we intend to build is 1800 square. [0:28:39, 0:28:50]: square feet. I know that's not a huge difference, but we wanted to at least mention that, you know, we we the minimum we would do is eighteen hundred and that that includes townhomes or otherwise. Um [0:28:50, 0:28:57]: Once again, we will be providing a traffic study and if warranted, left turn lane uh [0:28:57, 0:29:15]: the D cell lanes will obviously be added no matter what and if a light's warranted we would we'd be involved in in all of that participation. Um we did check with the county water and sewer is readily available for this project and can support the quantity of units that we're proposing. [0:29:15, 0:29:18]: Um I'll be happy to let let me go through [0:29:19, 0:29:21]: So you've got you've got some, you know [0:29:21, 0:29:25]: renditions of elevations of of what we propose the homes to look like. [0:29:26, 0:29:29]: Miss Linda already showed the site plan. [0:29:29, 0:29:38]: Um this is once again the amenity area. It's centralized the Mel kiosk, the clubhouse, the pool, putting green, pot lot, pickleball. [0:29:39, 0:29:59]: The the the sports field is all in the center of the community. So everybody can get there. When you get home, unfortunately in this day and age, we don't have mailboxes. I mean I do, but most people don't have them. You got to go to a kiosk. That's something that we don't like. Nobody likes, but it's required. We try to centralize. [0:29:59, 0:30:01]: So when you get home from work. [0:30:02, 0:30:18]: You can go get your mail right there at the front door at the clubhouse and then go. Or you can go home and get your kids and walk the sidewalks up to the amenities, spend some time, get your mail, however. So we try to and then like I said, this would be a version of of the the three story town home type product. [0:30:19, 0:30:20]: And um [0:30:21, 0:30:24]: More like a two story type product and there'll be a mix of twos and threes. [0:30:25, 0:30:35]: Um but I I'd be happy to to take the rest of my time to answer any questions you guys may have, staff may have, or for rebuttal for anybody who may be in opposition to this project. [0:30:36, 0:30:50]: Thank you so much, sir. Thank you, sir. Um I'm gonna start off with some board comments and I'm gonna kick us off here. Um few questions. I saw when staff was reporting about setbacks, are there gonna I didn't see any setbacks for the size of the town homes? [0:30:50, 0:31:10]: Yes, according to um so it there has to be twenty feet between the buildings. That's that's N FPA National Fire Protection Association code fourteen. So it doesn't matter if I we engineering Marietta or Stockbridge, twenty foot's a minimum because of firewalls and and the things. So you are gonna follow that that guy. Yes, we'll follow that exactly. Now where a townhome abuts the resident. [0:31:10, 0:31:20]: Residential, the residential rear setback will come into play and there'll be a side yard setback for the townhome of five. And then the rear setback for the home would be [0:31:20, 0:31:40]: what's defined, which I believe is a twenty foot front, a twenty foot rear, and five foot side. So um hopefully that answers your question. Yeah, I have a few more. Okay. Um and some of these are very short. Yes, absolutely. Plans to be gated? Is this gonna be a gated community or is this open? So we we would love to gate it in conversations with [0:31:40, 0:31:55]: with um Henry County Fire Department, they're not an advocate of of of putting a gate in and we're proposing a parkway style entrance where you've got two out, two in and a median, which to us that lends perfection for a gated entrance. [0:31:55, 0:32:01]: But they want a stacking off of flipping roads so deep into the property. [0:32:01, 0:32:08]: that it would it'd nearby nearby be impossible. Uh in my opinion, the only way a gated community could work [0:32:08, 0:32:28]: for Henry County's fire is for the property to be way larger than this, like a big master plan community or something. But if staff sees it as an opportunity for us to gate it, I think my client would be more than willing and want to gate it. Even if it was a faux gate, so it looked like it was a gated community, they would even be open to that. [0:32:28, 0:32:30]: It really depends on [0:32:30, 0:32:34]: You know, if staff can work with us in Henry County if approved. [0:32:35, 0:32:44]: to to to get it gated, we I think that would be something we'd all love to see. I think it would lend itself and honestly it'd make these residents feel much better about their community too. [0:32:44, 0:33:04]: Yeah, I'm not sure a gated community in that area would be a fit for that specific community or in that area because it doesn't fit the tone of that district. Okay. Let me ask, cause I know you got a water, uh a letter from our water into it from Hemory County. I love that. I know we don't have a traffic study, but that's fine because we are already aware of the uh big [0:33:04, 0:33:20]: building and construction of our expansions and our roads. But did you never mention an impact study? Like did you actually talk to those residents in those areas and those surrounding communities in that neighborhood that you said um had those single family homes? Did you all have an opportunity to have those conversations with them? [0:33:20, 0:33:29]: Um so uh Zach Zach you did? Yep. So so Zach Murray has been helping facilitate he's had dental surgery and so he's [0:33:30, 0:33:35]: not super available. But um he had taught us some s not only staff, but I think some [0:33:35, 0:33:42]: political people and some people in the community and and that's why we changed up and made it single family around [0:33:42, 0:33:45]: what we consider the residential and and I know [0:33:45, 0:33:46]: uh behind us or [0:33:47, 0:34:07]: What's the the opp opposite direction of flipping? I guess that would be to the west. There's some nice large estate homes. So furthermore, we we put a a buffer back there, we put single family homes back there. So, you know, once again, any let me say I think that's great, but my question was not the politics and the community, because I we community people and I don't live anywhere near that. [0:34:07, 0:34:15]: That that residency. Okay. My question is the people that are impacted directly in that area, did you have a conversation with that back neighborhood? [0:34:24, 0:34:32]: Thank you so much. Um and then also I had three more questions than I prom I mean. Yeah, totally. So and and no and [0:34:33, 0:34:40]: Don't don't don't badge me now. But is the property value gonna decrease for those homes that are in there because they're directly across the street from a town home? [0:34:42, 0:34:46]: Well, so the question is is how old are those homes? [0:34:46, 0:34:49]: Okay. Okay. Um these these new town homes are gonna be [0:34:50, 0:34:51]: Probably [0:34:51, 0:34:57]: Well into the threes, possibly fours, and the single families will be more than that. Is that is that a fair statement, Josh? So [0:34:58, 0:35:12]: Looking at the the existing sales in that area of existing homes, it's below that. Is it gonna decrease their value? I would venture to say they'll say yes. My statement is is new product, new price points. [0:35:13, 0:35:19]: If it was across the street from me, it would increase my value because I know my taxes would go up. So I'm just gonna shoot you straight. That's my opinion. [0:35:20, 0:35:36]: And what's your rental cap? Are we doing a rental cap at all or is this straight person? Yeah, there is no intent to do rental here. So whatever the city standard is for rental cap, we're fine with. I know most of the time it's no more than ten percent, but whatever the city of Stockbridge's regulation, we're amenable to that. There's no intent to make this a rental community of any kind. [0:35:36, 0:35:40]: Okay. And then my last um [0:35:41, 0:35:44]: I'll hold them and I'll pass it to another board member if they have any questions. [0:35:46, 0:35:46]: Yeah. [0:35:46, 0:35:49]: Right here, Vash chair? Go ahead. Go ahead. [0:35:49, 0:36:08]: Yes, I I was I actually love the amenities that are coming with this property. Yes, ma'am. So I commend you on that. But um I just had a comment and and just um knowing some single families um and the amenities that you're trying to offer. [0:36:08, 0:36:28]: I just feel like, you know, and speaking for m uh you know, for a single family that it's gonna fall you know, the mini the m the cost of the amenities and things like that are gonna fall on the backs of the single family. And it's you know, with the rent or the mortgage being, you know, as much as is as it is. [0:36:28, 0:36:33]: You know, I don't I'm not sure if you know this um [0:36:34, 0:36:41]: This property is giving single families a break, essentially. And and what's the the the makeup of it? Is it hardy wick hardy plank and wood? [0:36:42, 0:37:02]: Uh it it's a combination of bricks, uh rock and hardy plank uh is I believe the materials. Um Miss Miss Linda could confirm that, but I believe that's in the plan to charge single families about three to four hundred thousand for these? Uh no, the single families would be probably more into the four to fives and then yeah, the townhomes will be [0:37:01, 0:37:05]: definitely in the high threes and the fours. Yeah. [0:37:06, 0:37:14]: Yeah and and to answer your question, I didn't mean to cut you off so if you're if you uh we tried to pick amenities package that is less burdensome so [0:37:15, 0:37:16]: Play fields. [0:37:16, 0:37:36]: Take up a lot of room, but they're relatively inexpensive to take care of. The putt and greens that we put in, um, it's the new AstroTurf. The initial cost by the developer is pretty pretty strong, but they come with a 20-year lifetime warranty on the material. So in theory, if something were to go wrong, the HOA could submit. [0:37:36, 0:37:56]: For a warranty if it's within the first 20 years. After 20 years, yeah, they may have to upgrade it. Also, pickleballs last approximately twice as long as tennis tennis courts. Two pickleballs equal one tennis court, basically. And so you don't have expensive nets. The fencing usually stays, you know. [0:37:56, 0:38:16]: Pretty pretty good. So we tried to pick amenities that wouldn't be financially burdensome. Um, the pool, yes, we all know. And the clubhouse itself, we all know those those two items, they will be a financial cost. But with 151 residents, we feel confident that this amenity package ultimately the HOA. [0:38:16, 0:38:19]: uh dues would be very uh [0:38:20, 0:38:22]: normal to this community. [0:38:22, 0:38:30]: Whether it was built here or in Clayton County or in Douglas County or Atlanta, that 151 homes could definitely support it. [0:38:31, 0:38:31]: Yeah. [0:38:32, 0:38:37]: Define normal HOAV to me. So a normal HOAV, what do you what do you expect to H O V? [0:38:41, 0:38:41]: Do what now? [0:38:43, 0:38:47]: Yeah, they they haven't figured out the exact amenity fee because it's all gonna be based on [0:38:48, 0:38:51]: He has to leave a surplus in there. Correct. [0:38:51, 0:38:54]: So when the HOA starts, they're not broke. [0:38:54, 0:39:14]: So that comes into play, but the ultimately the monthly dues will will be a factor of what we ultimately determine what the maintenance cost will be. They haven't dove into that yet because this is so early into the cost of this, basically seeing if it can get annexed and zoned and then that'd be something that they'll have to, you know, comprise and and come up with. But uh [0:39:14, 0:39:25]: Hopefully that answered that. Sounds good, Commissioner? I have a question for you, sir. Yes, sir. Who determines whether a traffic light is warranted? [0:39:26, 0:39:46]: Can I okay. So um we'll submit a traffic study, and that traffic study is gonna determine how many vehicular trips are on that road now, how many vehicular trips we're gonna create and put on that road, and that includes Amazon, UPS, your neighbor, taking the kids to daycare, taking kids to school, the school bus. So all of [0:39:46, 0:39:52]: that comes into account and that study says okay x number of people are going to go right x number of people are going to go left [0:39:53, 0:40:13]: Flipping road has an X number of people going east, X number of people going west. If that traffic count meets a certain warrant ratio with number of cars during peak hours, then we are allowed by the ITE trip generation manual to be able to facilitate putting a traffic light in. [0:40:13, 0:40:15]: Personally, I think it already meets it. [0:40:15, 0:40:17]: I'm just being honest with you. [0:40:17, 0:40:18]: But [0:40:18, 0:40:24]: When we put our intersection and it's gonna be an intersection with St. Ives, that will be a true four-way intersection. [0:40:25, 0:40:25]: Where [0:40:25, 0:40:32]: it makes sense to have something at that location that regulates the traffic, both from safety and access. So [0:40:32, 0:40:39]: It's warranted one hundred percent by the number of vehicular traffics that is generated not only by us, but currently on that road. [0:40:41, 0:40:51]: I don't think you understood my question. Okay, I'm sorry. Oh, who will determine? It'll be staff. It'll be staff based on the ITE trip generation manual and the traffic study. [0:40:52, 0:41:12]: So they'll determine if it's warranted based on their criteria set forth in the IT. Yeah, there'll be DOT. It should be it should be stopped. Yeah, it should be Henry County DOT working with the city of Stockbridge to determine what the needs and wants are. Yes, sir. That's exactly right. Yes, sir. I'm sorry. Your your entrance is it gonna line up [0:41:12, 0:41:32]: Up with St. Ives on the street. Yes, sir. Mm-hmm. Parkway style. That would be a perfect setup for traffic. It would be an ideal setup. We intentionally did that. We knew that staff would probably want us to align anyway. Jogs are very dangerous. Somebody pulls out this way, somebody pulls out that way. So I I realistically think that a lot will ultimately go there. And it may be a [0:41:32, 0:41:37]: I share your sentiments a hundred percent. I I think so too. But [0:41:38, 0:41:42]: I would hate to recommend approval to the council. [0:41:43, 0:41:50]: Yes, sure. And then the council approves it. And then somewhere down the road it's determined that a light is not warranted. [0:41:51, 0:42:11]: You could place a stipulation that said that um we're voluntary to install a light if allowed by DOT or if warranted. We're we're the ones that say we we're happy with a light. It'd be safer for our residents, it'd be better marketability for us. We would love to put it in. We're okay committing to put it in so long as the governing bodies. [0:42:11, 0:42:16]: Allow us to put it in. So if you wanted to word a zoning stipulation that's that way. [0:42:16, 0:42:19]: We'd be amenable to agreeing to a voluntary stipulation that says [0:42:20, 0:42:22]: If staff says we can put one in, we'll put one in. [0:42:30, 0:42:30]: Okay. [0:42:33, 0:42:34]: Any other questions, Commissioner? [0:42:37, 0:42:39]: Mr. Chairman. Oh go ahead and miss the min and come back. [0:42:40, 0:42:52]: Go ahead. I have two questions. So I want to go back to the rentals. So to the rentals. Uh so would the developer be willing to put into the HOA covenant to restrict rentals, leasing, Airbnb? [0:42:53, 0:42:57]: Yes, absolutely. You can volunteer skip your license for that. Yes, sir. Okay. [0:42:58, 0:43:12]: We have zero intent to make a surrender community anytime. Okay, we're good. I had a second question, it went right out of my head that fast. So it comes back to me I'll I'll follow up. Thank you. Yeah, no problem. Thank you. Ms. Davidal? [0:43:14, 0:43:20]: Uh, what type of security will you have set up to deterrent crime in your community? [0:43:21, 0:43:24]: Uh and I apologize, my hearing's so bad. What kind of [0:43:24, 0:43:44]: What kind of system you're gonna set in place to deterrent crime in the community? Yes, sir. Um so I guess in any community, um if it ain't gated, you're at the discretion of of the criminals. Um obviously this particular property doesn't lend itself for any little nooks and crannies and corners where [0:43:44, 0:43:45]: Yeah. [0:43:45, 0:43:51]: People could hide or park their vehicles. It's a loop road, two entrances in, two entrances out. [0:43:52, 0:43:52]: Yeah. [0:43:53, 0:43:53]: It is [0:43:54, 0:43:59]: fully enveloped by homes and on the interior it's encompassed by homes. So [0:44:00, 0:44:04]: The likelihood of crime in this kind of neighborhood is less than if you had a [0:44:04, 0:44:06]: Straight road that dead ended. [0:44:06, 0:44:22]: You have the opportunity for them to set up or sell drugs at this place. I I realistically feel one, being it's a new community, it's less likely, but the second thing, it provides a circular traffic about it where if the police wanted to put it on patrol, which I'm certain they will. [0:44:22, 0:44:24]: They can literally hit it and drive through it. [0:44:24, 0:44:30]: In one second and be right back out'cause it's just one loop road and they can see everything they want to see. So [0:44:31, 0:44:46]: Can you eliminate crime? No, sir. Would gain it help eliminate crime? It would help reduce it. But to answer your question, I don't know that there's really a whole lot of safeguards that any community can do to save the crime. I mean they'll be required to install plot cameras at the entryway. [0:44:47, 0:45:00]: Yeah, and whatever the requirement by the city is, we'll be a we'll be amenable to have to do it. Let me ask Ryan, the require the condition on the document you all gave us says required if gated. So is that requirement for flight cameras in general? Because the paperwork says if gated. [0:45:02, 0:45:13]: In general? Okay. Any other questions, Commissioner? I have a question. All right. Vice Chair. So this is this property will be lo located in my district. Okay. Um [0:45:15, 0:45:35]: Uh is there any gonna be any stipulations with regard to subleasing because that can kind of mitigate, you know, crime and things like that? And when you're talking about subleasing the units and the houses and whatever So once somebody I'm just being honest with you, once somebody buys their home, it's tough for me, you, the developer, builder of the city to police who [0:45:35, 0:45:41]: lives or in but there there will be a caveat that no more than whatever the city deems [0:45:41, 0:45:49]: One person can only own one house in there, or maybe you make it five percent or one per two percent. I don't know, case a mom and dad want to buy their daughter one beside'em. [0:45:49, 0:45:53]: But there's zero intent from us to have any rental at all. [0:45:53, 0:45:56]: We're going to fee simple sell everything. [0:45:56, 0:46:03]: Now ultimately five years down the road, if somebody buys Unit thirty eight and they want to lease it out to so and so [0:46:04, 0:46:09]: There's probably nothing that we could put in place other than the HOA monitoring them to stop it. [0:46:10, 0:46:18]: But if we've got a zoning stipulation that we volunteered to put on here that's not gonna be a rental community, I think the city does have the the ability to. [0:46:18, 0:46:23]: Use that device to stop any kind of activity пост девелон. [0:46:23, 0:46:43]: Okay. But yeah, there's no there's no desire to do any lease programs. These are all build to sell town homes and all. There's not gonna be any rentals. It it's gonna build and sell. That's his intent. Okay. That's the city's ten percent correct. Great. [0:46:43, 0:46:43]: [2804.4, 2807.9]: Yeah, I that's usually the cap is ten percent. So no more than [0:46:48, 0:47:08]: Fifteen units could be h owned by one entity in this project. Now, I personally think that it should be one percent, but I I you know okay, you'll probably include that in your HOA or sounds good. Yep. And and we we're amenable to putting in any device you feel comfortable and maybe that's the city's experience before to s to to make it [0:47:08, 0:47:20]: Not rental. We have zero it's it's not intended to be rental, not ever. So thank you so much, sir. Yes, sir. Um I will now close the applicant's course. Yes. Chair, may I speak before you close it? Go ahead. [0:47:20, 0:47:40]: Since the young lady asked the question, one of the uh things we do in our own neighborhood, and I'm actually in the HOA neighborhood, the homeowner is always responsible for that property, no matter what happens, whether it's fines or interruptions in the community, it all goes back to the homeowner. [0:47:40, 0:48:00]: So the homeowner has to make sure that that property is maintained the way it should because we look at the ownership first. The renter, they're not the owners. So at the end of the day, the owner has to give the renters permission to be at the pool or any amenities when they're not. [0:48:00, 0:48:03]: When it comes down to our neighborhood, HOA. [0:48:04, 0:48:22]: Thank you so much, Commissioner. Thank you so much, sir. Mr. Chairman, thank you. I'm sorry. Yes. Happens to me often. Um so if approved by city council, what's the timeline to to turn dirt on the process? To be honest with you, um i it's our intent, if approved through this process, um we would begin [0:48:22, 0:48:25]: full engineering and submit [0:48:25, 0:48:30]: As fast as the process allows us and we're we're going full [0:48:31, 0:48:47]: full blown to to the it land development process. Um I have not developed uh designed or permitted anything in the city, so I don't know if that process is two months, four months, six months, eight months, but ultimately the project itself will take eight to ten months to develop. [0:48:47, 0:48:50]: And then it'll probably be about a three year build out. [0:48:51, 0:48:51]: So [0:48:52, 0:49:11]: If from today going forward you're probably looking at a total of four and a half to five years would be my guess for a finish out of one hundred and fifty one units. And that's why we're overly confident that the seventy five connectors should be completed unless something crazy happens and it it it would help relieve any additional traffic is generated. So [0:49:12, 0:49:32]: Thank you so much. I'm gonna now close the applicants portion and I'm now going to open the joint hearings uh for these three cases. If you would like to speak in favor of the annexation case, AX 2025-01, comprehensive plan amendment case, CP-2025-01, or rezoning case RZ-2021. [0:49:32, 0:49:38]: Um, if you would like to ask questions or make comments, please come forward at this time. Anyone in affirmative? [0:49:40, 0:49:42]: Anyone in affirmative? [0:49:42, 0:49:42]: Here [0:49:47, 0:49:52]: Awesome. Please make sure you sign one of the documents when you finish and come up to the podium, state your name and address. [0:49:54, 0:49:55]: You could do it after me. [0:50:21, 0:50:25]: Hello everyone. This is my first time no, this is my second time coming. [0:50:26, 0:50:46]: And I stay in Saint Margaret's village. And as he said that he came and talked to neighbors, I didn't get no nobody didn't come to my house. Only thing I got was a letter that came to my house. And I wanna know because my property sits on 118 and the land it is [0:50:46, 0:50:51]: There's a lot of land back there. I want to know it do I have to move. [0:50:52, 0:51:12]: Or you guys gonna buy some of the property or what? I don't know. Cause this is the fr I've been staying in this county thirty years. I'm gonna ask that you direct your comments to us. Oh and then the applicant had the opportunity to answer. Okay. Oh, I didn't know. Oh, please say your name and address, please. Sonia Cook 118 Saint St. Margaret Circle. [0:51:12, 0:51:18]: Are you against or for? [0:51:18, 0:51:25]: No, I'm not saying that I'm against it because well, I don't know. I take that back. [0:51:25, 0:51:28]: Because you know what, on flipping, it's a lot of traffic. [0:51:29, 0:51:34]: We don't have no traffic lights. Traffic be bag all the way back. [0:51:34, 0:51:48]: to 42. And then if it's an accident on 75, it's tremendous. So to bring in another community from where we already got a community on the other side. [0:51:49, 0:52:07]: That's a lot of traffic. And it's been a lot of major accidents on flipping. A lot of um we have some crime on on flipping as well. So I think that um y'all should really reconsider about the um [0:52:08, 0:52:10]: A votin' against it. [0:52:11, 0:52:31]: It's too much going on on Flippin' to have another hand over park to come there. I think that and then the prices of it. I mean Saint Margaret Village do have new houses that have moved over there. They built. And they got older houses. And that would depend on. [0:52:31, 0:52:33]: Decrease our value. [0:52:34, 0:52:39]: If they come. I don't know what he said. I think you say what he said, three hundred thousand? [0:52:40, 0:52:47]: Yeah, that'll decrease our values. Cause ours now is like three eighty to almost four hundred. [0:52:48, 0:52:50]: So I'm thinking that um [0:52:50, 0:53:10]: need to be some reconsideration for the people on flipping and uh hearing county. I mean I see a lot of property is moving, building a lot of homes. I don't see no homes for people with low income. It need to be people for people that's fifty, need somewhere to stay that they can be able to afford. [0:53:11, 0:53:18]: And these this right here, these people won't be able to afford this. It need to be somewhere that's affordable for single mothers. [0:53:19, 0:53:39]: See uh seniors they need somewhere that they can be able to afford to live in Henry County. So I really impose it. If that's what you were asking me, did I oppose it? Yes, I impose it. Okay. Thank you so much. Uh so let the record reflect oppose, not an uh on the side against is there anyone else that would like to [0:53:39, 0:53:41]: Yeah. [0:53:42, 0:53:45]: Anyone else that would like to speak against this development? [0:53:46, 0:53:51]: Anyone else that would like to speak against the development in these three cases? All right. [0:53:53, 0:53:55]: With that said, I will close the public hearing. [0:53:56, 0:53:59]: Uh the board will now make a vote on these three cases. [0:54:00, 0:54:06]: First, do I have a motion regarding annexation case, AX dash 25-01? [0:54:10, 0:54:11]: It's their motion. [0:54:19, 0:54:25]: I'd like to present a motion that we uh annex the property. Um [0:54:27, 0:54:30]: S C P twenty twenty five dash C R one. [0:54:31, 0:54:36]: No, annexation case. We're gonna start on annexation. Okay, you're gonna do the annexation. [0:54:46, 0:54:54]: Publication for analyzation is still it's uh number A X dash twenty twenty five dash zero one. [0:54:55, 0:54:58]: And you were making a motion to approve, correct? Is there a second? [0:54:58, 0:54:59]: Mr. Chairman, I second. [0:55:00, 0:55:07]: All right, it's been properly uh motioned by Commissioner Tibetau and second by Mr. Mitten. All those in favor please indicate by the sound of aye. [0:55:08, 0:55:09]: Uh [0:55:10, 0:55:20]: All those in opposed? All right. Three to one. Motion carries. Second, do I have a motion regarding comprehensive plan amendment case CP-2025-01? [0:55:26, 0:55:28]: I make a motion to approve. [0:55:28, 0:55:30]: All right, there's in a motion to approve by [0:55:31, 0:55:34]: Jesus. Vice Chair? Uh is there a second? [0:55:34, 0:55:36]: Uh Harold, I'll second it. [0:55:37, 0:55:44]: All right, it was second by Commissioner Thibodeau. All those in favor, please indicate by the sign of aye. Aye. Aye. All those opposed? [0:55:47, 0:55:48]: Are those bowls? [0:55:51, 0:55:52]: Did you vote commission? [0:55:52, 0:55:55]: I did. And if in favor. [0:55:56, 0:56:02]: Commissioner Min, did you vote as well? I aye. In favor? All right. Yes. Unanimous. [0:56:02, 0:56:05]: Mr. Chairman, who was um opposed on the annexation? [0:56:05, 0:56:08]: Uh one, Dumas. Dumas. [0:56:10, 0:56:16]: All right, last motion. Do I hear a motion regarding rezoning case R Z dash twenty twenty four dash O one? [0:56:19, 0:56:21]: Oh, don't get quiet now. [0:56:22, 0:56:34]: Mr. Chairman. Yes. I'll make the motion to approve. All right, I have a motion to move by Commissioner Mitten. Is there a second? A second. Second by Vice Chair. All those in favor, please indicate by the sound of aye. Aye. Any opposed? [0:56:34, 0:56:41]: Mr Chairman, are are the is the approval to adopt the staff's conditions or do they wanna add any conditions? [0:56:44, 0:56:47]: to the conditions in regards to the rezoning case, correct? [0:56:50, 0:56:59]: So I'm okay. I'm glad you said that. Thank you. I actually uh Do you like me to restate? Yes, but I actually have two requests for you, if that's okay. Um [0:57:00, 0:57:20]: I would like to do I would like to do the approval if you all do it with the conditions, but take out when it goes down to number two. Further, if security gates are installed, flight cameras shall also be installed. Change that language to flight cameras shall be installed. Period. And this is for the rezoning. For the rezoning. [0:57:20, 0:57:20]: Okay. [0:57:21, 0:57:25]: And I would like to add a condition also that we [0:57:27, 0:57:28]: Install a traffic light. [0:57:31, 0:57:31]: That is. [0:57:32, 0:57:41]: We wanna do uh you wanna add that as a condition? Yes. Okay, so we're gonna do uh flock cameras. And Mr. Chairman speak. Yes, sir. [0:57:41, 0:57:50]: Uh we need to make sure that property is completely fenced in. I didn't hear anything about anybody saying it's fenced in. You wanna add that as a condition? Yes. Sure. [0:57:55, 0:58:07]: They already have it. All right. Um I will now accept a motion with the uh for approval with the conditions set by staff and the updated conditions uh made by this commission. [0:58:07, 0:58:16]: I make a motion to approve. Yes, ma'am. The because there was already a motion and a second made, there needs to be a motion to amend the motion. [0:58:16, 0:58:18]: And then make a new motion. [0:58:18, 0:58:19]: All right, so motion to amend. [0:58:20, 0:58:26]: I make a motion to amend. All right. I have a motion to amend the current motion by the vice chair. Is there a s uh second? [0:58:26, 0:58:27]: Second it, Harold. [0:58:27, 0:58:42]: Second, Commissioner Thibodeau. All those in favor indicate by the sign of aye. Aye. All right. Unanimous. Now I will accept the new motion. Mr. Chairman, I make the motion for RZ 202501 with three stipulations to approve. [0:58:44, 0:58:45]: I say. [0:58:45, 0:58:57]: I have a motion uh to approve the rezoning case with the conditions set by the commission and staff. Uh there is a motion by Thibodeau. Uh sorry, Commissioner Mitten. Is there a second? [0:58:57, 0:58:58]: Arrow second it. [0:59:00, 0:59:06]: There's a second by Commissioner Thibodeau. All those in favor can indicate by the sign of aye. Aye. All those opposed? [0:59:07, 0:59:08]: Unanimous. [0:59:11, 0:59:31]: Alright, the next item on tonight's agenda pertains to a subdivision development proposal for parcel zero seventy-010201 at the southwest corner of Highway 42, North and Tunis Road. The sole case for this proposal is zoning modification case ZM twenty twenty-five-01. I will read [0:59:31, 0:59:51]: The case in the record after that we'll hear presentation from staff and then we'll open it up for a public hearing. Uh zoning modification case ZM-25-01, property located in Council District 5. Consideration of a request for a major rezoning modification at the southwest corner of Highway 42, North and Tunis Row to [0:59:51, 1:00:11]: Provide for modifications to the zoning conditions comprising development agreement for rezoning case RZ-03-45-S. The purpose is to allow the development of a single-family detached residential subdivision. The property owner is Highway Henry Highway 42. The applicant is Shaker Reddy. The property is located in Land. [1:00:11, 1:00:17]: And lot thirty one and thirty two of district seven and contains twenty seven point seven more or less acres. Staff please. [1:00:18, 1:00:26]: Yes, thank you, Chair. My name is Gore Linton, senior planner for the city of Stockbridge, and I'm here to present the case for ZM twenty five dash zero one. [1:00:29, 1:00:49]: The case facts. The applicant as mentioned is Shaker Reddy. The agent is Mr. Brian Mashburn who's here in attendance. Uh the address of the property is located at the southwest corner of Highway 42 and Tunis Road. The number of acres is twenty seven point two acres. Um the [1:00:48, 1:00:55]: Parcel ID number is zero seven zero-one twenty twenty-two zero zero one. [1:00:55, 1:01:15]: The current use of the property is vacant and undeveloped, but the layout of the proof subdivision is still visible through existing clearings. Uh the site is also heavily wooded and crossed by Wolf Creek with two existing access points from US Highway 23. The current zoning of the property SR and [1:01:15, 1:01:21]: And the proposed number of acres is two point one two units per acres, and the sign was posted on June fourth, twenty twenty five. [1:01:25, 1:01:45]: So this is the aerial photo of the property with the subject property shown here in yellow and uh with the red lines. And across from it is the Eagles Landing First Baptist Church slash Eagles Landing Christian Academy. We have several neighborhoods around the area, such as Highlands, Summit, Eagle, and Eagles Landing. [1:01:47, 1:01:55]: And this is the close-up aeri photo showing the existing layout of the uh gas and crossing. As you can see, the existing layout is shown here. [1:01:57, 1:01:58]: And also here as well. [1:02:01, 1:02:04]: And this is the flood map showing Wolf Creek. [1:02:10, 1:02:20]: And this is the existing road that leads to uh one of developments which is still uh shown to uh which we either side visit. [1:02:25, 1:02:29]: And this is when we posted the signs on June fourth, twenty twenty five. [1:02:32, 1:02:33]: We posted two signs. [1:02:36, 1:02:52]: And this is the joint zoning map of the property. As as you can see it's zone SR. And the surrounding uh zonings you have OI, LI, and PUD, and you also have MFR and C1. [1:02:54, 1:03:00]: And this is the surrounded property uh property tip, surrounded zoning property information. [1:03:01, 1:03:10]: And you also have M two in heavy industrial Henry County and you also have C three heavy commercial Henry County and then you also have M one Henry County as well. [1:03:12, 1:03:14]: And this is the joint future land use map. [1:03:17, 1:03:35]: And this is the surrounding future land use destinations. Uh the property to the north is high density suburban Henry County. To the south you have high density suburban Henry County and you have low density residential and low density mixed use and high density suburban. [1:03:37, 1:03:46]: This is the surrounding land use densities map and the subject property is shown here in red. And it is consistent with the surrounded uh subdivisions in the area. [1:03:48, 1:03:50]: And this is the overlay map of the parcel. [1:03:52, 1:03:54]: So in a a Parkway Mix East Overlay District? [1:03:57, 1:04:17]: And we now dive into the zoning history of the property. So the previous applicant, um, Triad Investment LSC originally submitted a rezoning request on August eight August 18, 2003 to rezone the subject property from M1 to RM2 Multifamily Residence District, Townhouse. [1:04:17, 1:04:37]: To construct one hundred and forty townhomes, which was known as Orleans Manor at Eagles Landing. On October 9, 2003, the Henry County Municipal Planning Commission reviewed the application and rendered recommended approval, subject to thirteen conditions. However, the Stockbridge City Council tabled the case during this [1:04:37, 1:04:57]: Meeting on November 8th, 2003, due to an active moratorium on multifamily developments within the city. On December 10, 2003, the applicant submitted a revised rezoning request and site plan to rezone the subject property from M1 to RN3 single-family residents to construct 73. [1:04:57, 1:05:10]: Single-family detached lots. And on June 10th, 2004, the Stockbridge Council approved the request with 14 conditions, and a development agreement was written and adopted soon after. [1:05:10, 1:05:30]: A preliminary site plan was prepared by Paragon Consulting Group and was submitted to Henry County in June 2005 as part of the development review process. This preliminary plan proposed 65 single-family lots, two designated amending areas, a loop walking trail, seven quality funds, and a five-foot setwalk throughout. [1:05:30, 1:05:31]: Throughout the subdivision. [1:05:33, 1:05:53]: And they also had uh setbacks of 40 in the front and and rear and ten on the side. And the plan received staff approval on July seventeenth, two thousand six. So the development of this site began around two thousand six-2007. However, the global financial crisis that occurred between two thousand seven and [1:05:53, 1:06:03]: two thousand nine resulted in the foreclosure of the site and eventually um the property was purchased by Henry Highway forty two in two thousand ten. [1:06:05, 1:06:10]: So this was the proposed town home that's was submitted on August eighth, eighteenth, two thousand three. [1:06:12, 1:06:17]: And then this was the proposed subdivision submitted on December tenth, two thousand three. [1:06:19, 1:06:25]: And then these were the conditions that were approved by Mayor Council on june fourteenth, two thousand four for the rezoning. [1:06:27, 1:06:33]: And these are the approved zoning conditions in the development agreement signed on june fourteenth, two thousand four. [1:06:35, 1:06:42]: And and and and it they had the s proposed subdivision as well on june fourteenth, two thousand four. That was included. [1:06:43, 1:06:51]: And this was the site plan that was submitted by Paragon Sunc Consultant that was approved by Henry County staff in July 17th of 2006. [1:06:54, 1:07:14]: And this was the original site development in two thousand six. And then the original development was in two thousand eight. But as mentioned, the uh the foreclosure occurred and that's when the property was um foreclosed, 2010. And if you look at Google Earth, you can s as mentioned, you can still see the layout of the subdivision. [1:07:18, 1:07:38]: Uh the development information, the the site the site plan that they submitted on June 10, 2005 features two cul-de-sacks and wine streets designed to enhance traffic circulation among the residents. The side plan also includes a many lot to the northeast corner of the property that is equipped with 16 amenity parking spaces, a playground. [1:07:38, 1:07:58]: A male kiosk, a pavilion with restrooms, and a pool. The property is divided by Wolf Creek, which runs through the center of the site and is protected by both a stream buffer and floodplain area. These natural features divide the site into two main sections with 33 lots located on the western side of the creek and 26 located. [1:07:58, 1:08:18]: On the eastern side of the creek. The Lassa houses range in size from 72 to 12,000 square feet. The site plan also includes three quality ponds, which are designed to treat the stormwater runoff before it enters Will Creek. In addition, the site plan includes both drainage and utility easements, which allows for the maintenance and installation of [1:08:18, 1:08:38]: Infrastructure. Uh the the currently the property is zoned SR, which is designed for low to medium destiny neighborhoods. The side plan shows a 10-foot front yard setback, 30 in the rear and in the center half side yard setback. Two entry points are located along Highway 42, providing direct access. [1:08:38, 1:08:58]: Access to the to this to development from this major artillery road. One entrance is located in the northwest corner of the site, serving the 33 lots on the west side of Wool Creek, while the second entrance is located towards the northeast section of the site, providing access to the 26th lots that are located on the eastern side of Wool Creek. [1:08:58, 1:09:18]: entrance access points in the neighborhood's internal street network. According to the letter from the Henry County Water Authority, which was received on April 29, 2025, public water and service is available for the proposed development. However, the service provision is contingent upon the repermitting of the gas and crossing development. [1:09:19, 1:09:30]: So these are the requested changes to the development agreement. Um condition four was that one third of the single story home shall be a minimum of twenty five hundred square feet. [1:09:30, 1:09:47]: Um instead they want to change it to one third of the single story home shall be a minimum of twenty four hundred square feet, and the reason being is uh a two thousand a twenty four hundred square foot home may not fit on all lots. And on condition six, the home exteriors uh included [1:09:48, 1:09:52]: Three sided brick stone or seventy five brick stone. [1:09:53, 1:10:11]: Instead, they wanna change that to the home front of the home shall be a mixture of fifty percent brick or stone and hardy plank or cementous fiber siding with a brick or stone water table on the two sides of the home. And the reason is to be markable and compete with a similar new development site in the area. [1:10:12, 1:10:32]: Condition 10 was that the hardwood street plant hardwood street trees required throughout the development. They want to change that to shall only be required along Highway 23 slash 42. And the reason is the distance between the front exterior and the street is limited. Uh no condition number twelve was that no minimum landscape. [1:10:32, 1:10:52]: Strip with between the sidewalk and the curb specific specified. Instead, the landscape strip between the curb and the four-foot sidewalk shall be minimum of 24 inches along all public streets. And the reason being is the amount of space is needed for the utilities. Condition number 14: Council approval required for all. [1:10:52, 1:11:03]: Home plans they want to change that to home plan approval shall be issued by the director of community planning or other staff prior to the issuance of approval of final plat. [1:11:03, 1:11:23]: And that's basically for to streamline the approval and allow administrative level review. And finally to condition number twenty, which is two amenity areas with extensive requirements, trail, pavilion, bathhouse, divided playground, pools, grills, trash parking. And said they want to have one amenity lodge that includes a pool, cabana, playground. [1:11:23, 1:11:30]: and parking lot. And that's to further clarify the development agreement's vague description of the development amenities package. [1:11:34, 1:11:40]: So we also reviewed the side plan uh comparison we reviewed uh t between two thousand five and twenty twenty five. [1:11:46, 1:11:55]: And this is the site plan shown here. Uh over here, it has the amenity slot, and it has 16 amenity parking spaces. [1:11:56, 1:12:05]: And a male kiosk centralized kiosk is located here where my cursor is. And they also have open space and the menu lot. [1:12:07, 1:12:27]: And this is the comparison analysis uh with the site plans. Uh they went from 65 to 59. Uh the track one or North Creek is they're both twenty-nine, and the south of Wool Creek was uh 2005 was 36, now it's twenty twenty-nine. Uh the minimum lot size went from ten thousand square feet. [1:12:27, 1:12:47]: To a mixture of 10,005 square feet, and some exceeding 40,000 square feet. And these are the setbacks. They the setbacks did change a bit. They had the same entrances, the sidewalks, 5'7 walks throughout. As far as our walking trail, they did. [1:12:47, 1:12:53]: Did have a walking trail in two thousand and five. Um they're open to keeping the walking trail. [1:12:55, 1:13:01]: And they also included a mail kiosk which was not included in the two thousand five site plan, um, but is it is in here. [1:13:03, 1:13:08]: And the renderings, these are the renderings and they wanna build it similar to the Wine Creek development. [1:13:13, 1:13:17]: This is the clubhouse. This is c the male kiosk and this is the clubhouse. [1:13:20, 1:13:40]: Um staff analysis. The request to up the as far as the reasonableness of the applicant's request, the request to update the original development agreement for gasoline crossing is w reasonable because the plan is over twenty years old and no homes were ever built due to the thousand eight crisis crisis financial crisis. The changes reflect upon modern [1:13:40, 1:14:00]: Houses trends like slightly smaller home sizes, new exterior materials, and updated lands landscaping. The updates don't change the overall plan but add clarity and new features like a male kiosk. Suitability for the proposed development. The revised site plan and changes are a good fit for the SR zoning district, reducing the home size from 25%. [1:13:59, 1:14:19]: To 2400 square feet for some home matches nearby neighborhoods, landscaping updates such as limiting street trees to Highway 42 and adding a 24-inch utility street with improved safety and access. And the new plan also adds a pool, pavilion, playground, restrooms, and a male kiosk. And these updates [1:14:19, 1:14:39]: Help move the project forward while keeping a strong design. As far as the effects on the surrounding properties and infrastructure, the proposed changes are not expected to harm nearby properties or city infrastructure. The site is surrounded by a mixture of industrial, commercial, church, school, and residential uses. Two entry points. [1:14:39, 1:14:43]: One two entrances on Highway forty two were served to development [1:14:44, 1:14:50]: Uh which had a traffic count of three fifteen hundred, three hundred vehicles per day uh in twenty twenty three. [1:14:53, 1:15:03]: And stormwater will be handled by quality pods and the developer is open to including the walking trail, as mentioned. And the density, as mentioned, is balanced with your surrounding subdivisions. [1:15:04, 1:15:15]: And staff recommends approval um with conditions. Um one third of the one story home should have a minimum of twenty four hundred square feet of the heated space rather than originally [1:15:16, 1:15:30]: Required 2500 square feet. The front elevation of all homes shall include shall consist of a mixture of 50% brick or stone and hardy plank or cementous siding with a brick or stone water table along both sides of the home. [1:15:31, 1:15:51]: Three, Hardwood Street Street shall be required only along Highway forty two. Four, a minimum twenty four inch Nancy script shall be maintained between the back of the curb and the four foot sidewalk along all public streets. Five, one designated amenities include a swimming pool, cabana or covered pavilion for. [1:15:51, 1:16:11]: Playground parking area. Six, a centralized mailbox makes sure it serves the entire development. Seven, the developers shall comply with all other requirements of the approved zoning case, RZ 345-S, including the original development agreement adopted on June 14, 2004. [1:16:11, 1:16:31]: four. Eight. Flock safety cameras shall be installed at each entrance of the subdivision. Nine. Attain foot sidewalk shall be installed along the highway forty two frontage of the subject property, and ten. The subject property shall be developed in substantial conformance with the revised site plan's title Gatson Subdivision Site Plan report. [1:16:31, 1:16:35]: Prepared by Acura Engineer and dated ju tenth, twenty twenty five. [1:16:36, 1:16:37]: And that concludes my presentation. [1:16:38, 1:16:40]: Thank you, Gordon. Are there any questions for staff on the board? [1:16:42, 1:16:54]: Yes, I have a question. Excuse me. There is railroad tracks behind that property. Uh what what are we planning on doing this for? Is uh some type of sound barrier? [1:16:55, 1:17:01]: Oh, that's something to be considered. Uh I'm just putting it out there to see if we have anything related to that. [1:17:03, 1:17:07]: Let me let me confirm with staff on that we have a a quiet zone in the city, correct? [1:17:08, 1:17:28]: It's just for downtown only though. Oh uh the applicant will ha will we'll have to address Mr. Thibodeau's question as far as the sound barrier, but there are no requirements uh in the code for a sound barrier. Uh but the quiet zone is just downtown. Gotcha. Um I'll let the applicant ask that. Um commissioner. [1:17:28, 1:17:35]: Thank you. Any other questions for staff? All right. Is the applicant present? Is the applicant present? [1:17:36, 1:17:38]: Please come up and say your name and address for us, please. [1:17:41, 1:17:43]: David. [1:17:45, 1:17:51]: My name is Brian Marshburn and uh doing this on behalf of Shaker Ready. Uh [1:17:52, 1:17:54]: Thank you. That's a bit better. [1:17:55, 1:18:15]: Uh Gordon, thank you for such a great presentation. I think Gordon hit all the highlights. I'm not gonna really review what he just went over in quite detail. Um basically the neighborhood was developed, it failed. Um it was purchased by Shakerady and a group of investors. [1:18:15, 1:18:20]: Um he's held it for a while. [1:18:20, 1:18:23]: We intend to redevelop the property. Um [1:18:23, 1:18:25]: Basically the [1:18:26, 1:18:28]: The current entitlements are already there. [1:18:28, 1:18:48]: We're only amending or modifying the zoning that's in place. So, really, the requests that we have in this list are modifications to the existing development agreement that was approved in 2004. So I'm not really I'm really making it better, to be honest with you. Uh our our request is to reduce the number of locks. [1:18:48, 1:18:56]: Lots because the lots that were previously uh proposed with the Gadsons Crawlson site plan that was prepared. [1:18:57, 1:18:58]: [4739.2, 4759.2]: Some of those lots aren't even buildable. Uh they're quite small. And um the reason for the request for the drop down from 2500 square feet to 2400 square feet is math. Six times four is twenty-four. It's a sixty by forty ranch style home. [1:19:19, 1:19:33]: won't fit easily on a sixty foot lot with seven and a half or ten foot setbacks on either side. Therefore, we asked for a slight reduction from a twenty five hundred square foot to twenty four hundred square foot to fit on some of the larger lots. Um [1:19:34, 1:19:36]: Uh the flock camera we're [1:19:36, 1:19:56]: Okay with that. That's something new and new technology. That's great. Uh the only thing that I would ask for for some grace from the staff recommendations would be for the ten foot wide sidewalk along Highway 41. And there is uh proposed, no, it's not proposed, it's already in the budget, the widening of Highway 42, uh, which will occur. [1:19:56, 1:19:59]: [4799.4, 4811.7]: And we were more than happy to prepare the sidewalks all the way up to Highway Forty Two. But right now there's nowhere for them to connect to. So essentially it'll be a ten foot sidewalk to nowhere. [1:20:11, 1:20:16]: Um we're happy to you know work by putting in some uh crossing [1:20:16, 1:20:23]: information to get from one side of the highway to the other because we do anticipate people walking from this community over to Eagles Annie Baptist Church. [1:20:24, 1:20:25]: Oh [1:20:26, 1:20:29]: That's all I have. I'm happy to answer your questions. [1:20:30, 1:20:35]: You refuse to put in a um ten foot sidewalk you would have problems. [1:20:36, 1:20:39]: Have problems at council? Yeah, there's a [1:20:40, 1:20:53]: railway master plan and they're requiring all uh new developments to have a ten foot wide sidewalk along the frontage. Even if even if it appears to go nowhere, the the theory is that somebody else would will one day develop something that would eventually connect. [1:20:54, 1:20:57]: Could we make it smaller, like a five foot wide sidewalk? [1:20:59, 1:21:05]: Okay. For so so as long as so long as I do it on the subject property. For for the subject property. [1:21:09, 1:21:09]: Okay. [1:21:12, 1:21:17]: It it just it doesn't connect to anywhere on the north side. It's a recycling facility. [1:21:20, 1:21:21]: So be it. [1:21:27, 1:21:28]: I I will [1:21:29, 1:21:40]: Okay. I d I just it doesn't I mean it's just sometimes I wonder who put these uh sidewalks to nowhere programs in place. Maybe it was a concrete lobbyist. [1:21:42, 1:21:43]: That's a funny joke, sorry. [1:21:43, 1:21:45]: Any other questions from the board for the applicant? [1:21:47, 1:21:59]: Uh yes, I didn't get any response. Uh well I didn't ask the question. What about uh railroad tracks in the rear as was uh some type of sound barrier? Do you have anything set up for that? [1:21:59, 1:22:00]: I do not. [1:22:02, 1:22:07]: Uh that's something I would consider because you know there's a train that passed in the rear of the property. [1:22:08, 1:22:20]: On Winding Creek subdivision, which is the long Campground Road on both sides of Campground Road, there's a whole nother subdivision that was just built on the north side of Campground Road. There's no sound barrier there, nor is there one on camp on uh [1:22:21, 1:22:24]: Uh Winding Creek, nor is there one on Eagles Landing. [1:22:26, 1:22:46]: There's a large berm that separates the two neighborhoods. So there's a berm that goes up to Eagles Landing, there's a berm that goes up to this subject property, and the railroad is in a valley that goes down through there. Um to be quite frank, the real really bottom line of us continuing to pursue a residential development here is the [1:22:46, 1:23:06]: The city uh staff about five, six years ago, long before COVID, is how long I've been working with this property, uh, did not want to see us revert the zoning back to industrial. We did have a lumber yard that wanted to go here. So uh therefore we're trying to make the property marketable and [1:23:06, 1:23:11]: And we kindly request these slight modifications to the existing zoning. [1:23:13, 1:23:20]: But, you know, I understand your your thought process with the sound barrier, but that's a pretty significant improvement. [1:23:21, 1:23:31]: It is, but it's something to consider as we move forward in in the future uh as far as billing homes and having people come in and uh [1:23:32, 1:23:50]: set up shop, but at the same time sometimes people come in and they find out that, hey, I didn't know the train was passing back there. You know, of course that's not something you're probably gonna be telling individuals when they move in. That's just something I'm saying to consider, if nothing else. Understand. [1:23:51, 1:23:52]: Thank you, Commissioner May. [1:23:53, 1:24:09]: Commission? Yes, I have a few questions. Um so HOA. Plans for an HOA? Yes. Okay. And in the covenant of the HOA, understand the city has a cap of ten percent on rentals leases with the Yeah, fee simple sold properties. Okay. Um [1:24:10, 1:24:24]: Any community engagement? I know that this is kind of a longgoing thing, but now that it's kind of reinvigorated some life into it, um letters gone out to the community, surrounding communities, uh community forum, speak with the local residents. [1:24:24, 1:24:44]: Uh we you know, we had a community forum meeting uh several weeks ago. I was here to present. Uh unfortunately we sent the letters and I don't think anyone appeared. Okay. So Okay. Um the the pro project kind of ice is kind of an island really. Um [1:24:44, 1:25:04]: You you don't have any residential right there. Uh there is residential diagonal across the street. Um, but I think this subdivision would be somewhat uniform to what's already there across the street. Okay. I I was questioning because it looked like there might have been residences to the west. Um it would basically butt up [1:25:04, 1:25:11]: to the to the there's there's there's a good bit of distance between there. I mean they're not gonna go walking through there. There's a railroad track. [1:25:13, 1:25:26]: Uh one last question. So um assuming that it it moved forward and went through city council approval, timelines for uh actually turning of dirt starting. Sure. Um the land disturbance permits expired. [1:25:26, 1:25:46]: So therefore the developer, Shaker, would have to uh resubmit development plans to be and the the previous plan that was approved, the old site plan, the lots are too narrow. So all of that gets changed. I mean, in the eyes of the city, all that would be a new submittable. [1:25:46, 1:25:52]: So that you're probably talking I don't I don't foresee it happening until March. [1:25:53, 1:25:55]: Twenty six. Twenty six. Okay. [1:25:57, 1:26:17]: Right. No further questions. Thank you. Thank you. Let me ask a quick question. Is the subdivision split because of the creek? Yes. So is there is there an entrance on both sides? Yes. Okay. So Yeah, and the reason that we request to reduce the the two amenities packages is it there's in the old development agreement it was really vague and it just said [1:26:17, 1:26:37]: Um an amenities package shall s serve each section. So I as we talked with uh Ryan, the development director here, it just seems like it would be a burden for a small neighborhood like that to have to support two amenities packages. So instead of having two pools and two clubhouses and [1:26:37, 1:26:57]: Well I think the package never really required a pool. You could have done because I saw you we have on here a pool, a park, right? All in one section. You could have split up park on this side, pool on this. [1:26:57, 1:27:17]: laid out um why the the amenities are all on the right side of the of the uh entire development, whether it's split or not. And then you have your uh your mailboxes if you're gonna do centralized mailboxes all the time. I know I I thought about that. I mean it was an afterthought during the meeting, but we're we would be willing to move uh I mean [1:27:16, 1:27:23]: I mean, a kiosk for a mailbox isn't that expensive. So we could put another kiosk over on the other side. Absolutely. Great. [1:27:23, 1:27:30]: Yeah. So I could we could put another set over by the pool. Okay. Yeah. That's fine. I I [1:27:30, 1:27:33]: Now would you all also be okay with Go ahead. [1:27:34, 1:27:53]: Uh possibly keeping the pool on the right side, but putting the playground on the opposite side? If there were room, so the the north side of the first slot when you pull in the neighborhood is uh misdrawn. So I could put a playground there. Gotcha. I mean it's not me doing it, just put it on the drawing. So yeah. Any other questions from the board? [1:27:54, 1:27:58]: But I I mean I prefer to keep it all in together if it's possible. I mean it [1:28:00, 1:28:01]: Any other questions from the board? [1:28:02, 1:28:20]: All right. Thank you, sir. Thank you. I'm gonna now open this up uh for a public hearing. Is there anyone here to speak in favor of this mo uh this case? Anyone to speak in favor? Hearing none, anyone here to speak against this case? Anyone here to speak against this case? [1:28:21, 1:28:24]: Yes, sir. Please make come up to the podium, state your name and address. [1:28:28, 1:28:29]: Make sure you come to the mic for me. [1:28:32, 1:28:43]: It looks it looks like it's a good project. Say your name and address. Uh Clay Henderson, uh seven oh two Summerbrook Court. I'm immediately across the railroad tracks from this this development. [1:28:43, 1:29:03]: And uh just had some some questions. Uh and the uh the biggest thing I think for me is uh security concern. Um we have industrial behind us across the track, and we have well I guess it's it's really some form of industrial all the way down. And [1:29:03, 1:29:10]: The old road, if you look at the m the map on the if you're facing the project on forty-two on the right side, that old road. [1:29:10, 1:29:19]: passage l used to cross the railroad track there. That used to be the crossing and it comes into my backyard. So there is um [1:29:20, 1:29:30]: arise of some sort, but my concern is having people in that community. You know, sidewalks are so important because of people walking. I get that. [1:29:30, 1:29:37]: I'm concerned about'em walking down the track and then that if now not to assume that anybody's evil minded. [1:29:38, 1:29:41]: But that once you cross that railroad track. [1:29:41, 1:29:42]: That is a very tempting area. [1:29:43, 1:29:55]: You know, and I've just that's a that's a concern for me. And I I agree with Mr. Thibodeau, I think we oughta have a a buffer wall about thirteen, fourteen feet high where nobody can cross it. [1:29:55, 1:29:57]: I say that lightheartedly, but I [1:29:57, 1:29:59]: Сірслі, а до концер. [1:30:00, 1:30:20]: about the back access of that property into our community there because it is an easy access. You know, right, we've got children that play right there and and um they're very expensive homes. You know, the the home um immediately um to the right of me just sold last year from [1:30:19, 1:30:35]: million three and that's you know I just think it's a I don't want to say targeting and not that anybody would but I think maybe having some um it's always a concern with the number of renters potentially and uh they don't take care of um [1:30:35, 1:30:55]: I don't want to say they don't take care of they don't have the same mindset as a homeowner, you know, there in the neighborhood. So um that was just one one one thought, just uh to consider some sort of uh and I don't want to raise any any additional cost for them, but I I just a thought for safety or you know security on the [1:30:55, 1:31:15]: Backside where that track is between there and the neighborhood. Um, and then um we I think you mentioned rentals, um, maybe capping that at 10% or something like that. Um, that would be fun. And um so the the revision from one-third of the of the homes from 2500 feet. [1:31:15, 1:31:29]: to 2400 feet. What about I never did see anything and I may have just missed this. What about the other two thirds? I mean is that a minimum throughout the entire community? Uh I never saw a reference that addressed the other two thirds. [1:31:33, 1:31:34]: Yeah. [1:31:45, 1:32:03]: Just the map that won't fit on the setbacks on the plot. Okay. Some of these lots that get at put together, they went they were screwy to be honest with you. They were like a foot wide. And I don't know what they were thinking, but they just put as many numbered units of on the plat as they possibly can get in there. Right. And and [1:32:08, 1:32:28]: So I I guess my question, and I'll rephrase it, is the minimum square footage of twenty four hundred, is that overall?'Cause it was only mentioned as to be two thirds of the property of the properties would be a minimum of twenty four hundred. Uh my my my question is there's still another a remaining two third that I don't know [1:32:28, 1:32:34]: You know, for that lance. So I guess that was my question. [1:32:34, 1:32:37]: So that's a minimum throughout. Okay. [1:32:37, 1:32:40]: So that's really my only my only question was just the the [1:32:41, 1:33:01]: to to consider something and I don't know what that resolution is, but just some something along that road track just as a a protective buffer between both communities, you know. So I mean these people wanna have some safety coming and going both ways, I think. So thank you. Yes sir. Thank you. As you leave, could you please fill out that form there and hand it over to staff. [1:33:01, 1:33:07]: Uh is there anyone else that would like to speak against in this case? All right, I'm gonna close the public hearing. [1:33:10, 1:33:29]: Mr. Chairman. Yes, sir. I just want to clarify a statement that was made. So my my request to the developer was I understand the city's cap on rentals is ten percent. I was asking for an HOA uh amendment in the covenant that would actually restrict rentals. If the uh applicant would be [1:33:30, 1:33:35]: Uh okay with that. Is the applicant okay with that? Okay. Um I'm gonna [1:33:35, 1:33:52]: Okay. Uh I do all right. We've closed the public hearing, so now the board will now take a vote. Uh I know we have some staff recommendations and so I actually have some questions on that for the s for the board. Um I definitely wanna make sure [1:33:54, 1:34:01]: Item number three, hardwood street trees uh shall be required only along the highway. Is that the current trees there? [1:34:06, 1:34:07]: Okay. Um [1:34:11, 1:34:30]: So I'd actually like for the board to probably reconsider that to actually have hardwood trees throughout the entire development, just to have some environmental justice and some environment and friendly opportunities there. Um uh number six, the applicant has already agreed to add a centralized mailbox on both sides since the development is split. [1:34:32, 1:34:44]: And then we already talked about the ten foot ten foot wide sidewalk, which is really non negotiable on our side as that's our comprehensive plan. But at this time I'll make a mo I'll accept a motion in regards to the zoning modification case. [1:34:44, 1:35:02]: I have one more question to ask. You know, I noticed we never say anything about uh pissing the property in. You're right. I was just about to say that. Yeah. It's right here too. You know, I mean uh he's talking security. I'm looking at security too. Uh we need to create some form of uh [1:35:03, 1:35:06]: divide against any uh [1:35:06, 1:35:15]: Elements that shouldn't be there. Let me just say that. And to come in the front with the flyer camera, that's one thing. But we got the rear and we got the sides. [1:35:18, 1:35:36]: So I will ac I'll accept or if you would like to add that as a a condition to add um fenced in the backing and the sides of the development. Yes, sir. Uh is there any more discussion in regards to it? I'll now accept a motion. Uh you want me to reread it? [1:35:36, 1:35:38]: Okay. [1:35:38, 1:35:42]: Well we don't have'em. Can I can I face it on those? [1:35:43, 1:35:45]: I don't know, attorney, can he say something now that we're voting? [1:35:47, 1:35:53]: Uh the applicant is asking I know we're now in the discussion of voting. Can the applicant come back since I closed the hearing? [1:36:03, 1:36:05]: I'll allow it. Come on up. [1:36:09, 1:36:29]: Thank you. So the property, the topography of the property, it goes up on the uh call it the south side of the property where the uh that's fluid drive. There's uh industrial building back there. There's actually two industrial buildings back there and a vacant industrial lot that fronts on to 42. [1:36:29, 1:36:34]: There's a school there and in front of there there's a commercial lot and it goes down. [1:36:34, 1:36:37]: And then on the north side it goes back up. [1:36:37, 1:36:56]: And along the back of the property there's a berm. So my proposal would be, if it you're okay with this, would be to put a install a fence along the back of the property and come up maybe say fifty feet into the back corners of the uh back corner lots to go all the way across the flat the [1:36:57, 1:37:00]: The railroad tracks and then back up. And then if uh [1:37:01, 1:37:06]: the residents wanted to enfence the rest of the neighborhood or the HOA wanted to do that, they could do that on their own. [1:37:08, 1:37:08]: Okay, G. [1:37:09, 1:37:13]: That then that would you would have this barrier that you couldn't just go walk across the railroad tracks there. [1:37:14, 1:37:18]: Oh, I would ask the uh homeowner that lives back there, how does he feel about that? [1:37:20, 1:37:21]: In the rear. [1:37:21, 1:37:22]: No more interview. [1:37:23, 1:37:24]: Thumbs up or damn. [1:37:26, 1:37:26]: Yeah. [1:37:27, 1:37:45]: 'Cause none of the other neighborhoods that uh join this railroad track have a fence. So Okay. Thank you so much, sir. Thank you. Uh I mean you can if you can make that suggestion. I mean, whether city council is up to not, you can put a condition on there to require a fence along the would you like to move forward with your condition? [1:37:45, 1:37:57]: Yes, I I'd like to have that condition, but also what he said, then uh if we need to have the HOA uh put the rest of it up, that would be a condition also if needed. [1:37:58, 1:38:11]: So would you like your condition to be the first one you said, which is um fencing it in around the sides and the back, or what the applicant just suggested, which would be a fifty foot um fence around the back of the railroad in the HOA? [1:38:11, 1:38:22]: I would go with the applicant and then uh also uh put some requirements through the HOA if they haven't one that they can finish the rest of it. [1:38:24, 1:38:44]: I think that's fair. Gotcha. Do you want me to read those back in for you? You would have to um I don't think you can put stipulation on the HOA. You would have to put that that um those conditions on the developer. He would have he would have to install that fence during the construction phase. Well we can go with what he said, but at the end of the day he would have control over the HOA. [1:38:44, 1:38:53]: yet because their votes would would trump anybody else while they building the homes anyway. So he still could put up the fence uh through the HOA. [1:38:55, 1:38:55]: [5935.6, 5937.4]: [1:38:58, 1:39:18]: We'll do it the way the applicant s uh wrote how we wrote it out. I'm gonna read them back to staff so that y'all can have the conditions amended by the um by the commission. Uh the first one stays the same, the second one stays the same, the third one would be hardwood street trees to go throughout the entire development, not just along the highway. Uh the fourth and fifth stay the same. [1:39:18, 1:39:36]: Number six is two mailboxes on each side of uh the development. Seven, eight, nine, and ten stays the same. We want to add a condition, which would be number eleven, which will be for the development to install a fence, a fifty foot fence around the back, around the railroad portion of the development. [1:39:38, 1:39:39]: And the HOA will decide the rest. [1:39:47, 1:39:52]: I was going to say that we we've closed public hearing. Um but [1:39:54, 1:39:56]: Are we good, Steph? [1:39:59, 1:39:59]: We get [1:40:05, 1:40:25]: Sorry. Um so we have just just three. Number three, uh hardwood trees throughout the entire development, not just on highway forty two. Number six, which is two centralized mailbox banks, not not one, one on each side of development, and then uh adding a a condition which [1:40:25, 1:40:45]: Which is number eleven, will be number eleven, which is which is to install a fifty foot fence uh to block the railroad in the back of the development. Ms. Chairman. Yes, sir. Unless I heard incorrectly, I don't think that's what he said. Is that not what he said? [1:40:45, 1:40:54]: Fifty feet on the sides. So it's up fifty feet on the sides.
