--- title: City Council Special Called Meeting date: 2025-06-16 source: 2025-06-16_City_Council_Special_Called_Meeting.wav --- [0:00:47, 0:01:02]: All right, ladies and gentlemen, I have now, let's see here, four fifty-six and I'll call the special call meeting to order on this um Monday, June 16th. And uh please stand for a prayer if you can. [0:01:04, 0:01:24]: Lord, thank you for bringing us together once again to do the city's business. Allow us to conduct and make logical decisions this evening. Be us always, Lord, in your name. Amen. And do pledge legislation. Pledge legions. The United States of America into the Republic before which it stands, one nation, under God, independent as well. [0:01:23, 0:01:25]: So the liberty and justice for all. [0:01:28, 0:01:30]: Madam Clerk, roll call please? [0:01:35, 0:01:35]: Present. [0:01:48, 0:01:49]: Present. [0:01:50, 0:01:51]: Present. [0:01:51, 0:01:52]: President. [0:01:53, 0:02:00]: Thank you, Madam Clerk. Appreciate that. Council, I need a motion to adopt the agenda, please. Mayor. Yes, sir. [0:02:00, 0:02:01]: Uh adopt the agenda. [0:02:02, 0:02:03]: Thank you, is there a second? [0:02:04, 0:02:08]: Second. Okay. Okay, Mr. Berry, second that all favor, please indicate. [0:02:08, 0:02:20]: Okay, so announced decision there. Okay, what first we'll have new business council consideration to approve the 2025-2026 liability insurance policy. Please. Renee. [0:02:31, 0:02:32]: A afternoon. [0:02:34, 0:02:35]: Is it Mike on? [0:02:38, 0:02:39]: Afternoon to you. [0:02:45, 0:02:47]: Property in my instruments. [0:02:48, 0:02:50]: have before you is council's consideration. [0:02:51, 0:02:53]: Happy look. [0:02:53, 0:03:12]: Of the 2025 general liability insurance for the city. Our renewal um date is uh upon us and we are pending, we're going through an audit right now based on our uh vehicle list. So what we're doing is we're asking for pending approval. [0:03:13, 0:03:14]: for the insurance that will [0:03:14, 0:03:17]: It needs to be re renewed by June nineteenth. [0:03:18, 0:03:20]: And then we will come back once the [0:03:21, 0:03:22]: uh audit is completed. [0:03:22, 0:03:25]: to have you uh approve the [0:03:25, 0:03:26]: Final numbers. [0:03:27, 0:03:29]: Okay. Any questions, council? [0:03:32, 0:03:33]: Wait f I please? [0:03:34, 0:03:37]: The current contract expires June nineteenth. [0:03:37, 0:03:38]: Yes. [0:03:39, 0:03:40]: Okay. [0:03:40, 0:03:44]: One of the concerns that I have consistently raised. [0:03:45, 0:03:56]: is um you leave no room for the council to provide guidance with you if you're bringing this to us three days before it expires. [0:03:57, 0:03:59]: We don't have any other choice. [0:03:59, 0:04:07]: But to approve it because it's being dropped in our lab. What I like to see is a compare is this the only quote we have? [0:04:09, 0:04:29]: Yes, this is the only quote. This is the broker that we have, and we're not asking, we're asking for pending approval for the insurance so that it would not lapse until we finalize our premium, our numbers uh that we need to do with the vehicle listing that we have. So it's strictly for the auto liability portion of [0:04:29, 0:04:35]: So we're just asking you did this go through procurement? [0:04:37, 0:04:41]: This this is a contract renewal. We don't have to go through procurement with this. I know, but [0:04:42, 0:04:48]: If it so it tells me that it didn't go through procurement, if it had gone through procurement [0:04:48, 0:04:49]: They would have known [0:04:49, 0:04:50]: Months ago. [0:04:50, 0:04:52]: That this was coming up for [0:04:52, 0:04:55]: renewal and they would have done their due diligence to get [0:04:56, 0:04:58]: additional quotes just to compare. [0:04:58, 0:05:00]: Cause I see that [0:05:00, 0:05:04]: With this renewal that you're asking for, there's an increase. [0:05:05, 0:05:07]: A premium increase. [0:05:07, 0:05:09]: Over a hundred thousand dollars. [0:05:10, 0:05:26]: Based on the increase in the number of vehicles that we currently have with the city, there has been uh a number of vehicles that have been purchased. Some vehicles were not on the uh curmer policy that was already covered. [0:05:26, 0:05:34]: When the in we went back to the insurance company and they found that those vehicles were on there that they not h covered from the previous year. [0:05:35, 0:05:38]: Then they added it in in there so there is an amount [0:05:39, 0:05:41]: There is going to be an increase. [0:05:41, 0:05:41]: From [0:05:42, 0:05:44]: One forty two to one seventy two. [0:05:44, 0:05:49]: We are looking at what those n what that number is, those thirty vehicles are. [0:05:49, 0:05:51]: Um to determine if the [0:05:52, 0:05:54]: Increase is warranted. [0:05:54, 0:05:57]: um under the auto liability insurance. [0:05:58, 0:06:05]: And under this we didn't have to go out to bid. I don't believe we w went forward with the current broker that we we have on on record. [0:06:08, 0:06:09]: Thank you. [0:06:09, 0:06:10]: You're welcome. [0:06:10, 0:06:13]: Any other questions, Council? Yeah, go right here, sir. [0:06:14, 0:06:26]: Yes, Miss Wheeler, were those thirty vehicles that were previously not on there, were they uninsured? Are these new vehicles or these vehicles that have been in the inventory for a while? They're pending the inventory as [0:06:26, 0:06:36]: um as as we speak. So we're determining if those vehicles were actually on the vehicle list that we sent over to the uh [0:06:37, 0:06:38]: insurance company. [0:06:38, 0:06:41]: For this year, when it came up for renewal. [0:06:41, 0:06:47]: And when the numbers when it came back, we started working on um reviewing that list. [0:06:47, 0:06:50]: This would have been brought to you uh thirty and thirty days ago. [0:06:51, 0:06:51]: But [0:06:51, 0:07:00]: Due to the increase in the premium, we wanted to verify the information that we were we had given to verify that the premium was justified. [0:07:00, 0:07:05]: And where what department of the thir do these thirty vehicles belong to? [0:07:06, 0:07:21]: We're looking at pub well, public works and police have the bulk of the vehicles that we're looking at. So that's where the audit is taking place. Okay. Do you have a breakdown of which of the thirties which which thirty go to public works? That's what we're trying to determine now. [0:07:21, 0:07:22]: Okay. [0:07:25, 0:07:25]: Thank you. [0:07:26, 0:07:36]: Well You go right, you got a question, sir. Yeah, so how many how Ms. Wheeler, so how many uh renewals do we have before we do have to actually solicit a bid? [0:07:37, 0:07:39]: Well we would [0:07:39, 0:07:56]: went through this uh whole process of uh changing brokers um about a year or two years ago um when risk management was uh switched over. And so when we go through the renewal is for the whole city of everything that properties, um [0:07:57, 0:08:07]: cyber security, everything that a city owns has to go on this. So what happens is that if there is no problem with the contract that we currently have, [0:08:07, 0:08:08]: With the vendor. [0:08:09, 0:08:19]: then procurement will send that over to us. I send it back that the vendor has met all the requirements uh that we needed, and then they basically [0:08:19, 0:08:22]: I send it back and we we go from there meet [0:08:22, 0:08:24]: With the vendor and um [0:08:25, 0:08:27]: go through the process of getting everything renewed. [0:08:27, 0:08:45]: So there is no three year one three nerd three year period, five year period, wherever it automatically goes back out to solicit to see what the market was there. No, not right now. Okay. Uh I thought we had something I guess uh I don't think we have that in there. I mean [0:08:47, 0:09:07]: Shakira's not here for me to ask of that question. Right, the witch Quinton was here. I thought that's what was real routine that we would send something out every maybe every three or four years to have it come back to us so that we understood truly what the market would bear. And uh certainly um I think that would be appropriate. And so this one you're you're saying it's on the [0:09:07, 0:09:17]: second year we just did it last year. So this would be twenty twenty two, twenty twenty four. [0:09:18, 0:09:21]: Із when we uh brought this before you. [0:09:21, 0:09:22]: Mm. Um [0:09:23, 0:09:25]: For the initial contract, I believe. [0:09:26, 0:09:29]: Is that some sir, do you have the daters? [0:09:30, 0:09:47]: Rikes, I I think we're parsing two separate things right now. The s the contract she's referencing. Please introduce yourself, by the way. Oh sorry, I'm forgive me. My name is Matt Simmons. Um senior director of Gallagher's Public Sector Practice. Uh I operate as part of your uh brokerage team. Um I think I can clarify um a few things on this. [0:09:47, 0:10:07]: So our job as the broker um is to solicit options for you every year. So there are um when we first became the broker for the city of College Park or sorry, I've got three council meetings today, City of Stockbridge. Um three years ago, we went out and took a look. Um some of the markets that are standard in this place um [0:10:07, 0:10:27]: Liberty Mutual, Trident, would not offer quotes on the City of Stockbridge for whatever reason, whether based on location, exposure size, loss experience. Gallagher, as your broker, is not paid by the city. We are, I think that that's where some of the uh confusion is coming, because typically from a procurement standpoint, for the brokerage services, we are not paid by the city, we are paid by the insurance company. [0:10:27, 0:10:47]: So there's not a next cost for the City of Stockbridge for our services. But what we do is we evaluate your options every single year. One of the things, one of the reasons we're looking at specific travels this year, your renewal is traditionally this time of year. Your fiscal year is January 1st, makes it very difficult to buy. [0:10:47, 0:10:55]: budget. What we're doing this year is, and we've negotiated this with travelers, is doing what is called a cancel rewrite. [0:10:56, 0:11:16]: What's in front of you is an annualized term. It's actually only going to go until December 31st, when we are going to reset your renewal date to align with your fiscal year so that moving forward, we can actually budget for we can put in the budget what we expect the renewal to look like. And moving forward, your renewal will come every year, January. [0:11:16, 0:11:18]: January one, which aligns with your fiscal year. [0:11:19, 0:11:34]: So that's one of the reasons why the focus has been on your current partner, because your current partner has the greatest likelihood of making an accommodation like that for the city of Stockbird so that we can better align and better budget and better manage your insurance program moving forward. [0:11:35, 0:11:55]: Well certainly I do understand that you're the broker and that you will be referring uh the best option and that you were opinionated. But my question basically was for your position, that doesn't go back out to anybody else. Surely there are other uh obviously you would probably do a fine job, but there are others that offer you a service, correct? Yes, sir. [0:11:55, 0:12:15]: Okay, so certainly uh a one to three would probably be appropriate for even this, so that uh we would evaluate what's going on with even this level, and I understand uh you know, but certainly others should be given an opportunity to be the broker for the city at some point. So um we need to look [0:12:14, 0:12:20]: At making that happen. This is the third year or second year. Do you have the dates? Do you have the dates, sir? [0:12:22, 0:12:42]: I mean when we first became the broker for the city of uh Stockbridge would have been in twenty um let me do the number of renewals that I've done. Um twenty four, twenty-five, twenty three, twenty four. It would have been um in uh I believe either the end of twenty two or the beginning of twenty three,'cause I believe that this is the third renewal that we have done [0:12:42, 0:12:44]: Uh for the city of Stockbridge. [0:12:44, 0:13:04]: Right. And typically what we had wanted was to see something every, you know, three years or so that would come back to the council. Uh that's kind of the language I think we had adopted in some procurement changes that we have made uh previously. So I think that's something that we should probably look into. Just everything that we [0:13:04, 0:13:24]: Do at the city at some point someone has an option at it and we could go back to kind of look at it. So that's kind of where we are now, but certainly we have business to conduct today uh in terms of where we are. And again, the the the expiration date is on July 19th, so certain June 19th, so that's only three days. [0:13:24, 0:13:31]: from here, so something has to be done. Also, I would like to ask you, sir, while you're at the podium, now it has been [0:13:32, 0:13:46]: said that the hundred thousand dollar in increase in the policies were related to new vehicles. Do you have a breakdown on what the increase is and how that should be explained uh from your side? [0:13:47, 0:14:07]: So you're looking at roughly about uh$79,000 of your increase is uh is attributed to your auto liability, um, which was going from 142 vehicles to 178 vehicles. Um so that's about$79,000 of the renewal is attributed there. Um the other primary [0:14:07, 0:14:27]: Primary driver on it is uh property. Um your property values were increased by five million dollars to keep up with uh the rate of inflation. Um and so we're seeing um and but also the property market continues to be very difficult as we see. I mean the month of months of May. [0:14:27, 0:14:41]: in June alone from a rain standpoint, we're seeing increases in storm activity, things like that. So we'll continue to see rates increase in property. But the rest of your uh renewal is primarily attributed when we look at that to the um [0:14:42, 0:14:49]: to the uh uh property mar uh property area and then there are a couple of other items um [0:14:49, 0:15:09]: And when you say property, you mean risk or you mean the the market value going? Pro no no the property in the cost for property insurance. And the and the increase in risk for property. The increase in the risk for the property. The risk the the risk is continuing to increase as we see, you know, we see what just in the fall we see what Hurricane Helene did to Georgia. Um that was a uh [0:15:09, 0:15:21]: um thousand year event um that came through. We are seeing increases in those type of storms. So we are seeing property rates continue to increase. Um which is where you see a uh a significant driver um [0:15:22, 0:15:36]: on your property premium. You'll see you'll note that it went from uh$122,000 to$150,000. Um and part of that is attributed to uh increase in values, um, but then just increase in exposure. [0:15:37, 0:15:46]: But not was that necessarily something that's just market wise or was that why it's it's it's a factor that [0:15:47, 0:15:47]: You know. [0:15:48, 0:15:50]: Wildfires in California. [0:15:50, 0:16:10]: That travel insurance impacts you. Coastal exposures impacts you because it impacts the overall underwriting of the uh of risks. Right. That's what I wanted to know. Was it anything specific related to anything the city had done? But this is just a market trend, is what correct. And when you look at the auto, auto rates just keep going up. You've looked at your own personal auto. [0:16:10, 0:16:23]: Right, certainly I've looked at the right. One of the things that we're hoping on is that the uh toll reform bill has a has a big impact on this stuff, but we continue to see s higher and higher verdicts, um, especially against uh local governments. [0:16:24, 0:16:25]: Thank you. [0:16:26, 0:16:27]: Ms. Gand, do you have a question? [0:16:28, 0:16:31]: I think um Councilman Alexander kinda [0:16:33, 0:16:44]: spoke on it. I see here that there's a difference in net rate changes that are drastically uh not really that large. Um I see the auto went up eighteen percent. [0:16:44, 0:16:50]: But and then you look at the physical damage, it actually went down twenty nine point six. [0:16:51, 0:17:08]: Um so are you saying that's due to the increase of auto you said that was due to the increase of automobiles that we have receiv we're getting. So your liability went up, um went up. Um it's not a it's not a perfect science, a perfect math. We we show out these analysts trying to help. [0:17:08, 0:17:09]: Show the story. [0:17:10, 0:17:15]: Um but when you when you note that your um your auto physical damage premium [0:17:15, 0:17:35]: Came down, the number of vehicles went up, but the premium came down. That's where we get with from a net standpoint. Um, you know, premium increase, less exposure increase. Um, so when exposures go down, and we try to look at that also, because for example, when you buy, um, if you buy 30 vehicles, you have to pay insurance for those 30 vehicles. And one of the things we want to show the story on is [0:17:35, 0:17:55]: It's not that the rates are going through the roof, it's that we have more exposures. Similarly, if we added five million dollars in payroll, your workers' comp numbers would increase dramatically. Okay. So that's what we're showing there. And to try and show kind of on a net basis what are some of the trends that we're looking at. Um, you know, there's some things in here. Um you know there has been claim activity. Um but they're not they're not due to [0:17:55, 0:17:55]: Thank you. [0:17:56, 0:18:04]: a car accident or anything, automobile accidents or anything of that nature. Correct. Well so your rates do shift based on your losses? [0:18:04, 0:18:24]: Um but we try to kind of show, hey, can we say is this um when we look at that net change, is the is, you know, we look for kind of reasonable realms of it for prime example is um your general liability, 11%. That's kind of an average market rate that that we're looking at, 18% on auto. It's kind of an average. [0:18:24, 0:18:36]: average market rate. If we saw a thirty five percent net rate change, we'd probably be talking about that there's some law it's some loss driven because that the rate is built out based on market factors and experience rating as well. [0:18:36, 0:18:56]: And what about employment practice liability? It went up twenty um twenty point nine percent. There have been some um uh there's been some claim activity there. Um so that's that's part of that's a part of that. Um that's not necessarily something for me um prepared to get into specifics on right now, but there has been claim activity. Okay. [0:18:56, 0:19:10]: So the cost of employment activities due to any claim activity. Exactly. And so the umbrella at forty six so we're we're up forty six point two percent. So I need to know, you know, I I understand [0:19:10, 0:19:30]: Just like a cost of living increase or anything else, you know, our cost of living, what is that 3.5% or something that we normally do, 3.3, 3.5. This is like double that in one almost 50% increase. And I need to know specifics on what's driving that so we can make arrangements to keep that down. [0:19:30, 0:19:37]: Um and you may not want to touch on that right now. We probably shouldn't, but um [0:19:37, 0:19:52]: I definitely wanna touch on it in executive session if that's part of something that we have to deal with. Um, especially if it is a twenty uh which cause a double, almost double under the entire umbrella at forty six point two percent. [0:19:53, 0:20:03]: Well as I mentioned s some of it is experience rated, some of it is market factors and and there's a there's a blend of those, but those things are certainly at a different time we can we can um [0:20:04, 0:20:13]: Oh I'm sorry. Um the there's the market factor and the experience factor and those things that we can talk about at at at a time when we're paired with that information. Okay. Thank you. Yes, ma'am. [0:20:15, 0:20:17]: Any other questions? Go ahead, please. [0:20:17, 0:20:24]: Um, Mr. Malazi, does this go through at least for our treasurer to review? [0:20:25, 0:20:25]: Yeah. [0:20:26, 0:20:28]: Mr. Malati. He's coming. [0:20:34, 0:20:39]: My understanding is you have taken a look at this. What is your recommendation? [0:20:40, 0:21:00]: I think that's the reason why she has said depending on the outcome of the assessment that is being done. So until then there's no figure that you are going to approve. The approval that you are going to make is just because of the three days that are there because [0:21:00, 0:21:20]: Um they have not accepted an extension. We did extend first one so that we could do the um assessment. Um then that one did not come up with what we wanted. The same questions that she has brought it up. Uh actually it's not 100. [0:21:20, 0:21:30]: over two hundred thousand increase. So pending on that then we will put the amount, if that amount can come down. [0:21:31, 0:21:37]: after giving out the reason why that extensive increase. [0:21:37, 0:21:42]: So should we expect that the amount would be greater than what [0:21:42, 0:21:48]: Is being proposed here today? It will be or will it be less? That's where we went to. [0:21:49, 0:22:09]: We want to hear. Otherwise you would have considered this the past council meeting that we had. So we asked for one month extension. Um it would have been due or expiring on the eighteenth of May, but we had to review why there's the [0:22:08, 0:22:25]: that hike. Why they that increase? And that process has not finished. So we ask for another extension, but they say they can't extend. Therefore we are we have three days. [0:22:26, 0:22:28]: But instead of asking you to approve it. [0:22:28, 0:22:31]: We are asking you to consider it [0:22:31, 0:22:34]: Depending on the outcome of the [0:22:35, 0:22:36]: I said Smith. [0:22:38, 0:22:46]: The forty two percent is just out of but uh they will help us to be where we are supposed to be. [0:22:49, 0:22:51]: That's how I can answer it. [0:22:53, 0:22:54]: Any other questions? [0:22:57, 0:23:01]: We met with the city manager, H. I was there. We met with them. [0:23:05, 0:23:18]: Okay. So you you're looking for an an um approval to extend it out a little further until you f have the final analysis, I guess you can say. So we do not stay without the coverage. Any coverage. [0:23:19, 0:23:25]: The coverage we need is it would have been there if there was an extension. So there's no extension. [0:23:26, 0:23:34]: then if the the don't extend come nineteenth will be out of coverage, which is not what we want. So we are compelled [0:23:35, 0:23:36]: To have it. [0:23:37, 0:23:40]: But without the amount there, because that amount [0:23:41, 0:23:43]: Unless otherwise we've changed. [0:23:43, 0:23:45]: Mm-hmm. [0:23:46, 0:23:52]: So otherwise council, I guess we need the verbiage to to ask for that and get your approval if that's the case. Will of the council. [0:23:54, 0:24:08]: How long do you anticipate after say we are able to give this approval today to make sure we have coverage beyond the 19th? How long before something will come back to this council that's more firm and concrete for long-term solutions? [0:24:09, 0:24:15]: It will be based on the outcome of the reconciliation that will be there. So w [0:24:18, 0:24:22]: Give you an example, our next council meeting after nice the twenty fifth of of this month. Would that work? [0:24:24, 0:24:27]: It's a possibility it will work by the twenty fifth. [0:24:30, 0:24:38]: We are finalizing the numbers as we speak. So once we uh finalize those numbers, we send it back to the broker. [0:24:38, 0:24:40]: For them to uh give to travelers. [0:24:41, 0:24:43]: So they can look at to make sure that [0:24:44, 0:24:45]: We're we we're [0:24:45, 0:24:47]: You know, comparing apples to apples. [0:24:48, 0:24:50]: Once that's back, then we will come back to the council. [0:24:50, 0:24:52]: Hopefully by the twenty fifth. [0:24:52, 0:24:57]: And I think we should be able to to provide that information back to council for your review. [0:25:00, 0:25:10]: Any other questions? Or whenever the next council is a good question. Yes, sir. Go ahead, please. Uh Mr. Mayor I just wanted I just wanna add uh uh Councilman Gann, um one thing I wanna make sure'cause obviously you're focused on the net rates and everything. [0:25:11, 0:25:17]: I did want to point out that when we look at the overall program from a net perspective to your point, we're looking at an eight and a half percent. [0:25:18, 0:25:19]: That is actually very positive. [0:25:20, 0:25:26]: So that again, it's kind of a yeah, I know that that's something that that you have great concern about and I was just no looking at it, I wanna make sure I made that mention to you. [0:25:26, 0:25:34]: That the net of an eight and a half percent is actually very good in the current market from an overall perspective. I just want to make sure that um I pointed that out. [0:25:34, 0:25:35]: Yep. [0:25:36, 0:25:39]: Thank you for pointing that. I appreciate it. [0:25:39, 0:25:59]: All right. So we have a a motion to go forward. Mayor, I make a motion that we give them this uh grace extension to explore um the policy coverage changes so that there is no lapse in coverage and pending a [0:25:59, 0:26:03]: uh follow up with counsel by the next meeting the twenty fifth. [0:26:04, 0:26:24]: To a second emotion. Mayor, I like the second emotion, but I want to emphasize what I said previously that the staff would go out and endeavor to look to see whether or not there are other options in terms of every program that we do in terms of the broker as well. So certainly I will let that would be appropriate in this situation as a second. Is that [0:26:24, 0:26:33]: Okay, Mr. Berry? Yeah. Yes. Is there an and also is there an NTE on this? I know we have eight thirty-one listed. [0:26:35, 0:26:38]: Uh not to exceed is there an amount not to exceed [0:26:41, 0:26:41]: Mm-hmm. [0:26:41, 0:26:51]: I if I may, this is the renewal provided by travelers and the other carriers that make up your program, whether it's the uh you have fiduciary pollution, um, cyber. Um [0:26:53, 0:26:55]: What is being undertaken is that [0:26:55, 0:26:59]: There is a question about how many vehicles are being properly rated. [0:27:00, 0:27:05]: There will be an adjustment based on the number of vehicles by the carrier because they have to [0:27:05, 0:27:07]: Прокур при то обтань преміум [0:27:07, 0:27:09]: appropriately for the exposure. [0:27:10, 0:27:17]: And so if there's 178 vehicles, this is your number. If there's a hundred and fifty vehicles, that number is going to come down. [0:27:17, 0:27:37]: If there's 180 vehicles, there's two additional vehicles that have to be insured that have to identify the insurance for it. Um so that is a variable number, but they have agreed that if there are fewer vehicles, they will provide a premium credit. Premium credit because there could be there could be vehicles on there that [0:27:37, 0:27:57]: should have been taken off, but somebody never communicated to the right department. And I know that one of the one of the things that we've been moving towards is that now that we have additional staff to focus on risk, we're able to start getting a lot of that stuff done, which can also address some of the issues around loss-driven experience and put a lot of programs and procedures in place. One of these, and while this is a [0:27:57, 0:28:09]: a difficult and painstaking process, it's a valuable process because we're starting to identify are we properly cataloging our exposures and reporting them and tracking them, make sure that other departments are communicating. But [0:28:09, 0:28:16]: It is potentially variable. Again, if there's two hundred vehicles that just weren't that are on the schedule, that will [0:28:17, 0:28:23]: being um those will have to be rated for to be insured for. Now if it turns out that there were vehicles that [0:28:24, 0:28:35]: haven't been in the past, I think you had this question, you were not without insurance on those. You're on what's called a composite rated schedule. So vehicles that are added and and subtracted during the policy term are automatically covered. [0:28:36, 0:28:49]: Um, but so if if it if you bought vehicles during the policy term, if you weren't without them, they're automatically covered by the way the insurance, we've structured the insurance. But if our reported vehicles are different, that number will change. Okay. [0:28:50, 0:29:05]: Uh Mr. Mayor, I um I'll amend that to say with the best rate possible language. All right. That it would present us the best rate. Okay. Based on the circumstances of vehicles that are either commissioned or decommissioned. [0:29:06, 0:29:07]: Moving forward. [0:29:08, 0:29:08]: All right. [0:29:09, 0:29:10]: With the language that I had, it's a second. [0:29:13, 0:29:18]: Okay. Did we get that I don't know, Miss Ms. Holiday, do you h have all that? [0:29:26, 0:29:30]: Twenty next count they said next council meeting the twenty. [0:29:36, 0:29:55]: Um right now pending a pending approval by the January twenty fifth meeting, you've asked for that to be with the best rate possible. Um and Council now added to look for options for other brokers. Is that part of the motion as well? Yes. Okay, so that's what I have now. [0:29:55, 0:29:56]: Okay. And that it's a good thing. [0:30:01, 0:30:02]: Yes. So [0:30:05, 0:30:21]: You all question just one comment. Let me just say this. I'm looking at the difference in what we're paying now versus what they're explaining or I um it's not that big of a difference. No. I mean, it really isn't. It's like [0:30:21, 0:30:28]: Um, for a grand total premium of six hundred and seventy-five thousand four hundred and ten dollars. That's our existing program. [0:30:29, 0:30:31]: In the proposed program [0:30:31, 0:30:45]: for twenty twenty five, twenty twenty six is a total of eight hundred and thirty one thousand eight hundred and sixty one dollars. So with the increase of the auto vehicles and some of the other explanations, I get it. Plus, I mean we all have these [0:30:45, 0:30:59]: increases everything is increasing. So I don't want anyone to think that I'm saying, oh wait a minute, they are robbing us blind. That's not the case. I just have some questions about some of the calculations in regards to things that our staff [0:30:59, 0:31:08]: And mayor and council needs to start paying attention to on what premium, what causes those increases besides the normal. [0:31:08, 0:31:12]: you know, I I say cost of living, but the normal market val market value. [0:31:12, 0:31:32]: Um, if there's something that raises a red flag that actually spikes, then I want to bring that to the attention of Mayor and Council. But the difference in regards to where we were these past years compared to now, I I don't see a great difference. I don't own I don't think it's outrageous. Just so in my opinion. [0:31:33, 0:31:40]: Okay, so we got a motion to a couple of different additions to that motion. Miss uh Holiday has that uh identified. Miss Barber, you have something else? [0:31:41, 0:31:43]: Yeah. Mr. Malazi stood up. [0:31:44, 0:31:47]: Yeah, something else you wanted to add. [0:31:47, 0:32:00]: I don't see there will be any difference by the next meeting with where we have come from and where we are now, expecting that on the twenty fifth it will be resolved unless he guarantees that it will be resolved. [0:32:01, 0:32:07]: Yeah, I I can't guarantee anything until we receive uh uh a vehicle count. [0:32:07, 0:32:26]: Okay, so if you don't think that in your professional opinion, what what type deadline do you recommend? So w if we wanna accept that deadline we can make some adjustments in the motion. My best was if they were to extend for another month because uh Mayor, we were together in the meeting, you know what we went through. It would be the same. [0:32:26, 0:32:32]: All right. So another month brings it back into July, which is July five July fourteenth, I believe it is. [0:32:34, 0:32:40]: But see the qu the the question really is the council would wanna council wanna wait that long and make the adjustments in the the motion for that. [0:32:41, 0:32:44]: Uh let's see here. Let's about double check uh what that date would be. [0:32:45, 0:32:48]: It is july fourteenth. Okay. So it would be we're talking about [0:32:49, 0:33:09]: You're talking about another next month, that's July fourteenth. Now that's up to the council if they want to m actually come, I'll tell you come back to Mr. Berry because you initially uh mentioned this. Yeah, I I feel the if the fourteenth is a more reasonable day date to address the vehicle inventory concerns because I think that's everything hinges on whether or not vehicles either stay on [0:33:09, 0:33:29]: Or come off. I think that's the biggest determining factor in this rate, right? Whether or not the new vehicles come on and then there are some older vehicles that will be coming off that are decommissioned. So that I guess the be better question is how much time will it take to truly do a vehicle inventory for the city vehicles? Is it 30 days? [0:33:29, 0:33:30]: Is it fifteen days? Is it a little bit of a little bit of a little [0:33:31, 0:33:51]: We are currently doing it right now. And the problem is that even with the older vehicles, if they are still on our property, we have to cover them. They have not been surplused. So until they're surplused and taken off the city roll, then we have to continue to cover them. So if [0:33:50, 0:34:03]: If they have sixty two brand new vehicles and thirty of them are old and they have not surplused them, we are gonna have to cover them no matter what. So, you know, that could be the difference. It could be that um [0:34:04, 0:34:10]: It could be a number of factors that I'm getting from the departments on exactly what they have on their property. [0:34:11, 0:34:12]: So [0:34:13, 0:34:20]: You know, we this is the number that we received the for the renewal for from the insurance company. [0:34:20, 0:34:22]: The broker has gone out. [0:34:22, 0:34:25]: He has gone out to the various companies. [0:34:25, 0:34:27]: to bring back us a renewal. [0:34:28, 0:34:36]: That's what the broker does. So it doesn't matter who the broker is, it's the insurance company that drives what we pay in premiums. [0:34:37, 0:34:46]: So if you don't foresee needing that extra time, we can leave the m the motion as it is. If you think So we need to the council ask the council to approve. [0:34:46, 0:34:50]: The liability insurance so the city will not be without coverage. [0:34:50, 0:34:52]: If there is a change, a credit [0:34:53, 0:34:54]: Will be issued. [0:34:54, 0:34:55]: Based on the [0:34:55, 0:34:56]: Vehicle [0:34:56, 0:34:58]: Listing that we're going to provide them. [0:34:59, 0:35:01]: And if not, then this number stays the same. [0:35:01, 0:35:06]: Yeah, but we cannot get an extension of thirty days. [0:35:06, 0:35:20]: I'm saying what Mr. Malazi just said thirty more. And we that we've already tried that with the insurance company. They will not an extension, but I'm saying to repass this and ask for what? We're asking for thirty more days to [0:35:21, 0:35:24]: To do the inventory on a pending approval? Uh-huh. [0:35:24, 0:35:39]: Good. So I guess you you brought this up. You you gave it you said about thirty days or w next meeting would be the fourteenth of July. You said that, sir, or y you recommended a long a time. So you your your thought process and how this can go. I don't want us to come on the twenty fifth [0:35:40, 0:35:44]: And we're still where we are today because [0:35:44, 0:36:04]: Mayor you know when we discussed initially it was we acquire new between thirty and forty vehicles. We didn't buy those vehicles. Right. Then at a later time it was it's not the old vehicles. They are the new vehicles. Ah the old vehicles, it's not the new vehicles. [0:36:04, 0:36:05]: This is the old vehicles. [0:36:05, 0:36:08]: Then we said, okay, if they odd vehicles [0:36:09, 0:36:10]: How did you [0:36:11, 0:36:12]: Cover them last year. [0:36:13, 0:36:14]: For the past two years. [0:36:15, 0:36:18]: Where were they those vehicles that now they are extra? [0:36:19, 0:36:24]: So those are areas where we get into the new extra thirty forty is no longer there. [0:36:25, 0:36:27]: But we have the new [0:36:27, 0:36:28]: Additional [0:36:29, 0:36:30]: For the vehicles. [0:36:31, 0:36:37]: that are old. So how did we cover last year or the past two years? [0:36:38, 0:36:42]: That's reconciliation. So if the we are reconciling something that was already covered. [0:36:44, 0:36:48]: So I just don't want to come the twenty fifth. [0:36:48, 0:36:53]: We may approve the same number because that reconciliation may not be done. [0:36:55, 0:37:07]: All right. So we accepted a later time frame might uh uh the next meeting after the twenty fifth is scheduled to be the fourteenth. It so otherwise is that acceptable or not. But they are saying if uh it passes the [0:37:08, 0:37:19]: twenty fifth, then it will not be covered. Now my question will be then how are we being covered to twenty fifth? How will be covered to twenty fifth? [0:37:19, 0:37:25]: Go ahead you go go ahead, sir. And it's I don't make it my business to get in the middle of city business, if I may. [0:37:26, 0:37:39]: The insurance renewal is ready to be approved. What I think is where everybody's trying to get towards, if I can demystify this, is to come back and provide a report on what is the actual number of vehicles and what, if any, credit or [0:37:39, 0:37:41]: additional premium is owed [0:37:41, 0:38:01]: based on the number of vehicles. Because what should happen today, for forgive me, my my my recommendation would be to approve the renewal so that the city can move forward so we can start moving towards our strategy of resetting your insurance date come this January so it aligns with your budget so that you don't have to run into [0:38:01, 0:38:21]: Did we budget for the increase or not? Because we've already planned for that. But then my recommendation would be to come back and say we've done an audit, we've identified that we have 185 vehicles, or we have 130 vehicles, or what is. Here's the results from the uh insurance carrier of a credit and/or additional premium owed. But um I can tell you that from a [0:38:21, 0:38:23]: Insurance renewal standpoint. [0:38:24, 0:38:27]: The insurance for the city of Stockbridge needs to be renewed. [0:38:27, 0:38:32]: B so that we do not lapse coverage at twelve oh one AM on Thursday. [0:38:32, 0:38:37]: Um because it's not just the travelers piece, it includes your cyber insurance, it includes your fiduciary. [0:38:37, 0:38:43]: Liability insurance could include your um um your pollution uh storage tank insurance. Yeah. Um [0:38:44, 0:38:51]: But I think that approve the renewal and then come back with a report on what are the number of vehicles, was there a credit or additional premium mode? [0:38:51, 0:39:11]: Mm-hmm. Okay. Thank you for that. Yes, sir. Yeah, I just cut to the chase. How much time do you need? You need thirty days for the pending approval? You need thirty days for that? What for me? I need I need approval to renew your insurance. But regarding a review of the of the vehicles, that's not something that I do. It's not something I can do. So you need a actual renewal. [0:39:11, 0:39:31]: Renew your insurance. I need to renew your insurance so that so that you do not go without coverage. The request that was made by the staff was to have a pending approval, so that's not something that you that you offer? No, no, no, it's not something that's I I think it was just a mixing of of of words. [0:39:31, 0:39:33]: Mm-hmm. [0:39:33, 0:39:53]: Approve this number pending that it could change, I think is is what we're looking at. Approve the renewal with the understanding that it could change because we did an extension. We brought this, we brought this to the city at the beginning of May. There was a we're an extension was requested to identify did we have the right number of vehicles? And we are now at the end of that extension. Um we had each carrier uh provide that. [0:39:53, 0:40:13]: That extension. And so we want to go ahead and get you moving forward because we know that we can make the adjustments once we identify the vehicles. In terms of a vehicle audit, that's not on our side, it's on the city's side. Well basically what you need is what was told to us is there's no pending. You need an actual approval. I need approved in order to move. [0:40:13, 0:40:33]: Forward, you will bring back a revised or a revision of what uh if there is one. If there is a revision, we will bring that to us to notify us of what that might be. But if we don't have an approval today, our insurance is gonna lapse on the nineteenth. Yes, sir. So the correct NTE is actually on this paper, which is the eight hundred thirty. [0:40:33, 0:40:38]: [2439.1, 2459.1]: Unless there are more vehicles than 178. And then there will be additional premium. But if there are less vehicles than there's less vehicle that can come down. Um correct. Um and again, this will not all be born in this fiscal year because strategically we are restructuring it so that you no longer are trying to budget for a May renewal. [0:40:59, 0:41:02]: in October, which is near impossible. [0:41:02, 0:41:18]: And if we were to remove certain vehicles from the fleet as well at any time, there can be an a an adjustment at any time. Not not at a we're doing this based on the confusion right now, but because be also because you in a normal policy term. [0:41:19, 0:41:21]: You can add vehicles, they're not gonna charge you additional premium. [0:41:22, 0:41:23]: It's called non auditable. [0:41:24, 0:41:33]: So they're not going to charge additional premium for if you buy five vehicles during the policy term, you're not getting charged for that. So they're also not going to give money back for it because they're just going to say, here's what we said. [0:41:34, 0:41:48]: Here's what we've got. And as you add them in, and we check, we check it at the end of the year. So we can make sure that we for the next renewal, we're ch we're charging for those. But the way we've structured the insurance, they don't give money back. You know, if you sell a bunch of vehicles in [0:41:48, 0:41:49]: December. [0:41:50, 0:41:54]: There's not a credit on that. We're doing a credit right now because there is. [0:41:55, 0:42:00]: um uh ambiguity and confusion over the actual count. Um [0:42:00, 0:42:04]: For similarly, if there is under vehicles, they're not charging you for this current policy term. [0:42:05, 0:42:12]: for the thirty vehicles that weren't on there. They're not gonna come and get money for that because they're not auditing it for that. Um [0:42:13, 0:42:14]: But what? [0:42:15, 0:42:24]: As your broker, I need is approval to renew your insurance so that it can move forward. And we will then move forward trying to figure out what is the right number of vehicles. [0:42:25, 0:42:28]: So sir. Ms. Holliday. [0:42:30, 0:42:32]: eight hundred thirty one thousand eight sixty one [0:42:38, 0:42:42]: Th this is this is the these are annualized numbers. [0:42:43, 0:42:49]: That is over twelve months. That is what your annual renewal is because it was also a question of [0:42:49, 0:42:53]: The assumption was the city would want to do this so that you can align it with your fiscal. [0:42:53, 0:43:00]: But the way that travelers does as opposed to doing a short-term policy, they do what's called a cancel rewrite. [0:43:00, 0:43:09]: So that and it's in part because then we're gonna s be staying with travelers because they are making the accommodation for us. So they will do a cancel rewrite. It's a it's it sounds [0:43:10, 0:43:15]: Weirder than it is. But effectively we are going to restart the un the renewal process. [0:43:16, 0:43:17]: In [0:43:17, 0:43:21]: August that we began this past uh November. We're gonna restart it. [0:43:22, 0:43:29]: and put together a new renewal to put in front of you this uh for this coming budget cycle. Ho and hopefully be able to present that in November. [0:43:30, 0:43:50]: For a January renewal. January through December. And from now on, it will be January through December. We already have some of your carriers have agreed to do a short rate. So again, these are annualized numbers because we want to show you what the annualized number looks like, as opposed to just saying, hey, here's your short term. Because then it's harder to show apples to apples. What did the actual rate change do? [0:43:49, 0:43:50]: Yeah. [0:43:51, 0:44:00]: So to further clarify, the 831 number is what you may or may not credit or increase based on the inventory offer. [0:44:00, 0:44:00]: Correct. [0:44:02, 0:44:03]: Okay. [0:44:04, 0:44:24]: I mean it's really there's really uh understand mayor, there's really no other choice. I mean we got I mean we we wanna have insurance pass the nineteenth we gotta pass this uh uh and then certainly look at uh bringing those numbers back. As you said, it's a cancel rewrite. So basically on twelve thirty one it'll be canceled and rewritten basically under the same [0:44:24, 0:44:37]: terms to match up with what we had. This budget cycle is not going to occur eight hundred thirty one thousand. Right. It will occur seven months prorated at that rate, correct. And then we will restart it and then we will have everything straight moving forward. [0:44:38, 0:44:53]: So uh basically based on that, uh you ready to make the motion? Well yeah, I just wanna make sure that your your motion is clear. And I wanna make sure that you got everything okay. And we we're looking at still the th uh the twenty fifth or the fourteenth of July? [0:44:53, 0:45:03]: That is a question for the city. Can you still say the twenty fifth? I think we can do it. Yeah, because we're almost finished. Okay. Okay. All right. So be it. So I think we're good with the motion then. All right. All in favor of motion, please indicate. [0:45:04, 0:45:09]: Nam's decision. I mean, I'm sorry. Um I'll oppose? You're opposed. [0:45:11, 0:45:15]: You approve. Okay. Four. Four zero. Thank you. Thank you. Appreciate it. Thank you all. Uh huh. [0:45:16, 0:45:18]: All right. On that note, uh [0:45:19, 0:45:25]: Council, we need to need to go to an executive session, personal legal, real estate. So move. Is there a second? [0:45:25, 0:45:27]: I say okay. Okay. I'll find present okay. [0:45:29, 0:45:35]: Okay. Shortly. Soon. [0:45:36, 0:45:37]: Alrighty. [0:45:49, 0:45:51]: I didn't think about the pin too. [0:46:24, 0:46:27]: Hi, Council, I need a motion to end our exact session, please. [0:46:27, 0:46:29]: Slow move. Is there a second? [0:46:30, 0:46:30]: Okay. [0:46:30, 0:46:33]: I'm Mr. Berry Secondette. Matt, I forgot to ask. Are we back live? [0:46:35, 0:46:36]: Rup. [0:46:38, 0:46:41]: Okay, did that d that did the live feed catch that motion?
