We actually have a quorum. So uh we we have a quorum. Uh so I just wanted to make sure so we can get going here. Um on that note, uh there we go. On that note, uh Anita, Council, I need a motion to end our executive session, please. [0:00:19, 0:00:20]: So moved. [0:00:20, 0:00:21]: The second [0:00:22, 0:00:25]: Second. Go on for it, please indicate. [0:00:27, 0:00:28]: Okay, Ms. Gantt. [0:00:30, 0:00:34]: Okay, there you go. Okay, Council, I need a motion to reconvene our [0:00:35, 0:00:36]: Uh work session, please. [0:00:36, 0:00:39]: So move second second. [0:00:40, 0:00:40]: Level. [0:00:41, 0:00:42]: All right, uh [0:00:43, 0:00:44]: All right, all in favor, please indicate. [0:00:46, 0:00:54]: Okay, good. Okay. On that note now, out of our uh second session, we had a couple things that uh we want to bring public that we discussed. [0:00:55, 0:01:00]: And so um Mr. Williams, uh think you have something uh that you need to add here for us as as well. [0:01:01, 0:01:14]: Y yes, sir. Based on the executive session discussion, a motion would be in order to authorize the mayor to sign an intergovernmental agreement and related documents with the downtown development authority related to [0:01:15, 0:01:16]: The downtown property. [0:01:17, 0:01:18]: So move. [0:01:18, 0:01:19]: Okay. [0:01:20, 0:01:25]: All right. Okay. And looks like Councilwoman Barber's coming in. [0:01:27, 0:01:37]: Um there we go. Our motion has been made and and been seconded in reference to the me signing the IGA. Okay. [0:01:37, 0:01:39]: And so all in favor of the motion please indicate. [0:01:40, 0:01:40]: I [0:01:42, 0:01:43]: Okay. [0:01:44, 0:01:52]: And uh okay. I'll just uh just add I need Ms. Gantt to state her vote because she's not present on the screen. [0:01:53, 0:01:54]: Okay, thank you. [0:01:55, 0:01:56]: Okay. [0:01:56, 0:02:10]: So um I believe that passed, Mr. Mayor. I I I didn't see I need to see I'm sorry, uh Mr. Turney. I I didn't see three votes for that actually. Okay, I I I I don't know. So [0:02:10, 0:02:17]: Where's Mr. Blount? Oh, I was uh I mean he's haven't signed in yet. I mean we we uh everybody's here, we got a quorum. [0:02:17, 0:02:19]: Um his aspect [0:02:19, 0:02:21]: Well, it's two to two, you gotta vote. [0:02:22, 0:02:23]: I abstain. [0:02:23, 0:02:25]: Oh, you are staying well this okay. [0:02:26, 0:02:27]: I abstain. [0:02:29, 0:02:43]: Well, you know, I I guess that's pretty unique on uh on that, uh Mr. Williams. If you got uh four v people voting and you have two flavor for that and two a stain, what happens? Do I still get a chance to vote? Technically it's not a tie. Not a tie? Yeah. [0:02:45, 0:02:50]: You sure? Yeah. Legally are you sure? [0:02:52, 0:02:58]: Because I would'cause actually if it if if it was a tie in this aspect, that's what's illegally, I would vote for it. Oh [0:02:58, 0:03:00]: I mean d different [0:03:01, 0:03:06]: um interpretations have been made of that situation over the years. Some [0:03:06, 0:03:11]: judges have said that the effect of the abstentions is that the [0:03:12, 0:03:12]: Куам [0:03:13, 0:03:16]: necessary for a vote goes down. Um, but [0:03:17, 0:03:36]: The problem with that in this case is that the charter says you need the affirmative vote of it of at least three or the mayor if there's a tie. Well that that we're not in a tie situation in that situation. So'cause it'cause what that really means is it's two yes and no other votes. And so that that [0:03:38, 0:03:44]: So either you you you wait to have a third vote or or it just doesn't pass. [0:03:45, 0:03:53]: Okay. Miss uh Miss Barber, you had something else you needed to add in reference to our decisions at the executive uh session. What was that? [0:03:53, 0:03:54]: Yes. [0:03:55, 0:04:00]: I move to authorize the mayor to approve the modified contract. [0:04:00, 0:04:02]: For the city attorney. [0:04:02, 0:04:03]: Okay, is there a second? [0:04:04, 0:04:04]: Second. [0:04:05, 0:04:06]: Okay, all in favor of that please indicate. [0:04:09, 0:04:12]: Um uh Councilwoman Gantt, uh you gonna vote? [0:04:15, 0:04:17]: Councilwoman Gain, we need to hear your vote. [0:04:20, 0:04:22]: I sorry, I gotta unmute. [0:04:23, 0:04:26]: Okay. Give me a second, y'all. No, you we hear you now. [0:04:26, 0:04:32]: Okay, so that's the S the Namis and that that uh piece. And we had a uh third uh [0:04:32, 0:04:36]: A third uh uh uh issue that we had to uh vote on. [0:04:37, 0:04:43]: And um that dealt with our our our actual uh chart, our uh organizational chart. [0:04:44, 0:04:50]: Okay. Oh yes, I make a motion that we um approve these changes to the organizational chart. [0:04:51, 0:04:54]: Uh the main the main street would move [0:04:54, 0:05:14]: From the community development area over to the economic development direct uh director uh up um department immediately. Uh we would have the event staff report to the city manager directly and the position of assistant. [0:05:14, 0:05:15]: City manager. [0:05:15, 0:05:17]: uh would be eliminated. [0:05:17, 0:05:19]: Okay, is there a second to [0:05:19, 0:05:20]: of that motion. [0:05:21, 0:05:22]: I second that. [0:05:23, 0:05:23]: Okay. [0:05:23, 0:05:25]: All in favor of the motion, please indicate. [0:05:27, 0:05:37]: Okay. Um Okay, so and Councilman Blount, you're now with us. I couldn't get on for some reason w w uh can you restate the motion again? [0:05:37, 0:05:42]: The motion the motion dealt with all the changes what we wanted to make to the the organizational chart. [0:05:45, 0:05:45]: Yeah. [0:05:46, 0:05:47]: Yeah. [0:05:48, 0:05:59]: Mayor, can we go back to the first one stand by one second. Stand by one second, please. Uh Councilman Blount, the motion that we just m made and we voted on dealt with the changes to organizational chart. [0:05:59, 0:06:01]: And and the three stages. [0:06:01, 0:06:02]: That's why. [0:06:02, 0:06:06]: You're you're in favor of that. Yeah, but I couldn't get on. I don't I didn't hear the other motion. [0:06:07, 0:06:07]: Okay. [0:06:08, 0:06:14]: The the last motion we just made will make uh the clerk will make that one a unanimous decision on the organizational chart. Okay. [0:06:16, 0:06:16]: Got that? [0:06:18, 0:06:18]: Mm. [0:06:20, 0:06:30]: Vanessa? I'm sorry. Yes, I have all the changes, yes. Okay, okay, good. So it's the NASC. I have all the changes, yes. Okay, and and it's a the NAMS decision on that one. [0:06:30, 0:06:34]: The first motion dealt with once again, Mr Williams. [0:06:35, 0:06:43]: Oh so Mr. Mayor, no action was taken on on the first motion. So uh if the council deems it so, a motion would be in order. [0:06:43, 0:06:53]: To authorize the mayor to execute an intergovernmental agreement with the downtown development authority in related documentation relative to the sale of a downtown property. [0:06:54, 0:06:55]: Oh move. [0:06:55, 0:06:57]: Is there a second? A second. [0:06:57, 0:07:00]: All right. Now all in favor of the motion, please indicate. [0:07:02, 0:07:03]: Okay, all posed. [0:07:05, 0:07:06]: Sustained. [0:07:07, 0:07:20]: I abstain. And for the record, um, for the city clerk, will you just add just for the record for me that I have not had the opportunity to review the IGA? [0:07:20, 0:07:22]: that we are proving right now. [0:07:23, 0:07:24]: Just for the record for me. [0:07:28, 0:07:47]: Oh Mayor, with that vote um having passed, then um a motion would potentially be an order um expressing the sense of the council disapproving of any container uh park uh projects within a mile of the downtown area. [0:07:48, 0:07:50]: That's a resolution you're referring to. Is that correct, sir? [0:07:50, 0:07:53]: Yes, sir. Okay. Okay. Second. [0:07:54, 0:07:55]: Correct. [0:07:55, 0:08:01]: Sec second, Mr. Alexander. Ms. Alexander, so uh second that all in favor of that, please indicate. [0:08:02, 0:08:03]: Three [0:08:03, 0:08:05]: Any all polls? [0:08:06, 0:08:06]: Abstain. [0:08:07, 0:08:27]: Okay, so it's three zero two. It passes. Okay, on that note, a few comments from from me.
