[0:29:17, 0:29:31]: Yes, I'll I'd just like to inform the public of what's going on. It's an exciting day here in Stockbridge. We're moving forward with some great initiatives uh led by Ms. Harris Bragg, our main street manager, to brand the city. [0:29:31, 0:29:51]: to market the city uh so we can let everybody know what great things that Stockbridge has to offer. Uh in the past we've seen some uh our marketing efforts haven't been as as robust as we like them to be. If you drive up and down the interstate you see uh signs from various cities and uh incorporating inviting them in. [0:29:51, 0:30:11]: Letting them know that they have a welcome environment. Uh we endeavor to do that at the city of Stockbridge, um led by Miss Harris Bragg in terms of redeveloping our downtown area and having a cohesive marketing strategy uh for our city. Finally having one piece that says this is why you should visit Stockbridge, uh highlighting [0:30:11, 0:30:31]: our Martin Luther King Senior Heritage Trail highlighting all of our city parks and events that we have here in the city. So I want to commend Miss Harris Bragg for our championing this cause and let you know that today how many of you all have been around and you you know how many of y'all know where Merrill Manners Conference Center is and you know what we'll finally have a [0:30:31, 0:30:44]: sign to show you where Merrill Mandis Conference Center is and where um you know our city parks are uh uh uh wayfinding signs like you see in other cities to direct you there. So this is a great initiative for our city. [0:30:45, 0:30:46]: Any other comments from the council? [0:30:47, 0:30:50]: Okay, I need a motion to accept the resolution. [0:30:51, 0:30:52]: Most ways? [0:30:52, 0:31:00]: I make a motion to s accept the branding and marketing recommendation that has been put forward by Main Street Manager Kier Harris Breck. [0:31:00, 0:31:01]: Okay. [0:31:02, 0:31:03]: Any further discussion? [0:31:04, 0:31:06]: If not, all in favour please indicate. [0:31:07, 0:31:09]: Okay, there we go. [0:31:09, 0:31:11]: Thank you, sirs and madam. Thank you. [0:31:12, 0:31:17]: And n item number two deals with an ordinance. City Historic Preservation Ordinance. Ms. Braggs, please. [0:31:17, 0:31:37]: Okay. As I stated before, I made um a presentation to Mayor Pro Tem and Council at your August workshop workshop session. And what we wanted to definitely push forward as a Main Street priority is the establishment of [0:31:37, 0:31:56]: historic preservation ordinance. As I mentioned at that particular presentation, one of the four components of Main Street is historic preservation. And historic preservation ethic or a city having a historic preservation ethic is key to that particular component of Main Street. [0:31:57, 0:32:17]: Um by establishing a historic preservation ordinance, we would also put in place a historic preservation commission. Once that commission has been established, we will be better able to maintain design guidelines in the historic district, establish a historic district, and also be eligible for federal [0:32:17, 0:32:22]: um and local funding available to historic preservation efforts. [0:32:22, 0:32:40]: So it is my staff recommendation that we move forward with establishing a historic preservation ordinance, which will in turn um make us eligible to become a certified local government, which again enables us to be eligible for um funding on levels that we are not able to apply for at this time. [0:32:41, 0:32:41]: Thank you. [0:32:42, 0:32:45]: Council, any comments in reference to the ordinance that's before you? [0:32:46, 0:32:49]: You wanna say something? Yeah. [0:32:50, 0:33:10]: This is um just for anyone everyone to know that this is uh something that's well needed and it's and it goes on the line of what we're doing in the city now because we have to put different entities or programs in place and and uh start start different programs to get different funders and the fact this is a part of the groundwork that's going to be laid to uh further put stop bridge on the [0:33:10, 0:33:15]: the map because a lot of things about Stockbridge forest uh historic preservations [0:33:16, 0:33:21]: a a lot of the uh when you move here you you have no idea how much history is in this city. [0:33:22, 0:33:42]: history is all across this city but without the without having an entity or a program put in place and have these uh um everyone work toward that goal to uh to preserve the history, we first of all we identify the history, we preserve it and then we get funding and also to promote the the history in Stockbridge. Stockbridge is a unique place to live and I move here to live. [0:33:42, 0:34:02]: And to learn what I've learned over the twelve years living here in Stockbridge has been astronomical. So I I I I commend you for the what you're doing right now with these programs coming forward because uh not just looking for outside funding but we're gonna have we'll we'll have inside funding for these programs and you all will be very surprised on the history of the [0:34:02, 0:34:05]: see their stock race, but you all will know pretty soon. [0:34:05, 0:34:25]: Okay, comments. Just one more since we got this nice crowd here tonight, we need some volunteers for the historic preservation board and we need some of these citizens to step up because uh you know what we're trying to do as a council is like like Councilman Blount said is to embrace the history. Once it's bulldozed, you can't [0:34:25, 0:34:39]: And if we try to sit down that marker now to say that, you know what citizens will get decid you will have an impact on what we do going forward. So we need some of you all to step up and volunteer to serve on the on the board. Yes, sir. [0:34:40, 0:34:40]: Thank you, sir. [0:34:40, 0:34:42]: Any other comments? Okay. [0:34:43, 0:34:44]: On that note, uh need the uh [0:34:44, 0:34:46]: A motion to accept this ordinance on C [0:34:47, 0:34:48]: Uh historic preservation. [0:34:49, 0:34:50]: [2091.3, 2094.8]: I move that we accept the ordinance on uh city historic preservation presented by [0:34:55, 0:34:56]: Um Miss Kerr. [0:34:56, 0:34:58]: Bre uh [0:35:00, 0:35:02]: Ms. Robinson? [0:35:03, 0:35:05]: Give it a second there. Any further discussion? [0:35:06, 0:35:07]: All in favor, please indicate. [0:35:07, 0:35:13]: Okay, it's unanimous in that aspect as well. Thank you, Ms. Bragg. Thank you, sirs and madam. Have a good evening. [0:35:18, 0:35:28]: I have here a council consideration request for funds for the amount of four hundred dollars for governing body miscellaneous funds for expense of a yoga fitness event presented by Councilman Alexander. [0:35:28, 0:35:31]: Don't leave yet. [0:35:32, 0:35:52]: Uh yes, I am asking uh for some funding. We're gonna do something real fun that uh I see uh see done in communities all over Metro Atlanta. We're gonna have a yoga and fitness event uh at the Eagles Landing Monument at the Council approves, right at the corner of Rock Quarry Road and Eagles Landing. Uh at the memorial. [0:35:52, 0:36:12]: Memorial um Eagles Landing Park right there below the tower. There's a great beautiful piece where uh they do like um outside yoga events and fitness events at the old Fourth War Park and different areas in the city of Atlanta. I've had several residents come to me and say, Why don't we have something like [0:36:12, 0:36:31]: like that here in our area. An outdoor event where we'll have fitness uh experts, uh yoga instructors uh instructing free classes for the community. Uh we'll um have a DJ out there if the council so approves and it's just a coming together of the community because um [0:36:32, 0:36:52]: We just we need to make sure that we're living healthy lives and that we're living as long as we possibly can uh through using exercise and nutrition. Uh Stockbridge has great facilities, parks, we have a walking trail, uh, and park areas that we need to take advantage of that don't cost us anything to [0:36:52, 0:37:12]: live a healthier lifestyles and ha to learn from these experts what you can do even when you're sitting in your office chair during the day when you don't have much time in order to partake in exercise and activity. I'm calling on the council to approve uh this measure out of council initiative funds that were set aside earlier in transfer uh [0:37:12, 0:37:32]: to um a different account uh so we could approve it as a hold. The money was budgeted uh for this fiscal year. Uh what uh we'll have is that uh we'll have uh t shirts how however uh many that we can afford from the four hundred dollar uh allotment that will say uh Stockbridge active and city of Stock [0:37:32, 0:37:45]: Stockbridge only. That's the only uh print that they will have on them for participants that come and uh partake with us in making sure that we uh we understand that we're living healthy and productive lives in the city of Stockbridge. [0:37:45, 0:37:57]: Okay. Any further comments? Yes. Go right here, Councilman Alexander. Um I talked to uh Councilman Alexander earlier about the program what he what this initiative to uh learn what he was doing, uh to get more in detail and [0:37:57, 0:38:17]: Um it's it's focused on uh health, it's focused on fitness and the and a lot of that is going on right now in the city of Stockbridge, not only here within the city uh boundaries, but to bring it outside the doors and to implement that that into to the communities. Uh I I I'm gonna approve this program because I I think it's uh it's a start to bring to show that we [0:38:17, 0:38:22]: We uh we are concerned about uh eating better and and living more healthier. [0:38:22, 0:38:23]: And as you can see I can [0:38:24, 0:38:26]: I can be out there doing a little yoga myself. [0:38:28, 0:38:29]: Okay. [0:38:29, 0:38:30]: Any further comments? [0:38:31, 0:38:34]: Okay. No further comments on any motion to [0:38:34, 0:38:42]: uh accept uh or to uh transfer the four hundred dollars out of the uh governing body of miscellaneous funds for this particular event. [0:38:43, 0:38:57]: Mayor pro Mayor Pro Tem, I make a motion that we can um for the council consideration to transfer funds in the amount of four hundred dollars from the governing body miscellaneous funds for the expenses for the yoga fitness events. Okay. [0:38:57, 0:38:58]: There you go. [0:38:59, 0:39:00]: Any further discussion? [0:39:01, 0:39:03]: That all fair please indicate. [0:39:03, 0:39:06]: There you go, you nails. There you go. Outstanding. [0:39:06, 0:39:10]: Okay, so I would imagine Miss Neighbors, uh you have that mission. [0:39:10, 0:39:11]: Made their work, right? [0:39:11, 0:39:12]: Thank you very much. [0:39:13, 0:39:13]: I [0:39:14, 0:39:18]: The next item is item number four. Planning zoning deals with uh red oak [0:39:19, 0:39:22]: Village amenities approval, parcel [0:39:22, 0:39:40]: Zero five zero dash zero one zero zero two zero zero five and zero five zero dash zero one zero zero three zero zero four consisting of twenty point one acres located at uh the east side of Rock Roy Road at uh Red Oak Drive in landlots twenty nine and thirty. [0:39:40, 0:39:45]: of the twelfth district applicant Tony C. Frey. Mr Dale Hall, please. [0:39:49, 0:39:51]: Thank you, Mayor and Council. [0:39:51, 0:39:53]: Mayor Proten and Council. Appreciate it. [0:39:54, 0:39:54]: Um [0:39:55, 0:40:07]: This property was brought to the city council back in June of twenty fifteen when it was zoned to RM multifamily residents. [0:40:08, 0:40:14]: for uh specific senior housing. At that time there was discussion on specific [0:40:16, 0:40:19]: Well, I I'll I I have that just [0:40:19, 0:40:20]: Oh. [0:40:21, 0:40:22]: Um this uh [0:40:23, 0:40:37]: Where it's located, I'll start there. It's located on Rockhoy Road in the red area, uh south of uh Banks Road, and what was being questioned and asked for is specifically this. Um [0:40:43, 0:40:45]: Again, it was annexed [0:40:45, 0:41:05]: and zone to RM for senior housing. And at the time there were discussion about RM in our current ordinance requires that there certain amenities be placed with RM developments, multifamily developments. And some of those uh are more active uh type things like [0:41:05, 0:41:25]: Like uh I think one of them is uh tennis courts are allowed, uh softball diamonds, football soccer fields, things of that. And when the applicant came in, uh the applicant was saying that this is a senior housing thing. So the applicant wanted the uh council to consider some other more senior housing appropriate amenities that we [0:41:24, 0:41:27]: weren't listed in the code at the time. [0:41:27, 0:41:47]: It was to be a formality that these would be approved uh by uh staff at the time when it came in through plan review. And but we wanted to bring it in front uh the council tonight and say that the proposed amenities that were discussed at the time of the zoning in twenty fifteen are what has been [0:41:47, 0:42:07]: recommended. I have the site plan to show you also what these are. And those items are specifically a community room and gathering area, about 1,500 square foot inside the building, an equipped computer center and library of 250 square feet, an equipped fitness center, a senior recreation sized pool, a community [0:42:07, 0:42:27]: Community garden area, equipment playground, and equipment in a playground area, and then a covered pavilion. These site amenities that were requested to be approved by the council at that time were not listed as approved amenities. So I'm bringing it forth again to get approval from the council. It's recommendation from staff. This is what was [0:42:27, 0:42:37]: discussed at the present time and then again it meets the requirements of what was proposed and placed as a condition of zoning at the time. [0:42:39, 0:42:42]: I'm also bringing up right now the site plan of the site. [0:42:42, 0:42:43]: Which shows [0:42:45, 0:42:47]: where the items again would be laid out. [0:42:49, 0:42:52]: This is Rock Choy Road. This is the north side of the site. [0:42:53, 0:43:02]: The drive comes in off Rockway Road and curves around. Out in this side area there would be a pavilion and playground. [0:43:02, 0:43:12]: the buildings along here and here's where the parking area is. And then on the other side of the site there's a pool and community garden area or garden area for those uh individuals on site. [0:43:12, 0:43:23]: This is a higher elevation than the road, so this is set up from the road. And then those other amenities like the library and meeting space would be internal to the building. [0:43:23, 0:43:28]: I'd be more than happy to answer any questions, but what we're looking for tonight is just uh uh [0:43:29, 0:43:42]: Uh approval from the council saying this is acceptable as per the conditions of the zoning that was brought forward in twenty fifteen. Who's first? Uh council. Who wants to ask the first question? Go right here, sir. Okay. [0:43:44, 0:43:45]: You want to go first? [0:43:47, 0:44:01]: Yes, sir. Ms Mr Hall. Now there was a pre existing ordinance with requirements stated uh that I've that you we talked about, correct? They're asking for an exception from the existing ordinance, is that correct? [0:44:01, 0:44:08]: They they were approved for an exception for that in twenty fifteen. And the exception was instead of having [0:44:09, 0:44:29]: certain uh amenities there these amenities would be added to the list to be considered as approved amenities. So yes. Okay. Uh well I know I understand seniors do like to play tennis and one of those requirements was for a a what was for tennis, right? Is that it there's a list of amenities that need to be choose from and [0:44:29, 0:44:31]: And that list of twenty items you could pick. [0:44:32, 0:44:40]: like five or six of them. Mm-hmm. So there was a list. You didn't have to have all of them, but you had to pick some of them. And these are uh so that [0:44:40, 0:44:44]: Tennis was one of the items that was on the original R M, yes. [0:44:44, 0:44:57]: Okay, so tennis was on the was on the original RM and then as I do recall what they r they requested to co move down from an Olympic size pool or something like that to the size that's stated there, is that correct? [0:44:58, 0:45:15]: Yeah, the the ordinance is pretty vague in how it says pool. It says there's a required pool. Olympic size pool is uh an incredibly large pool. I'm not sure that the code states Olympic size, but it does say a certain size pool. So this is the one that they brought uh [0:45:15, 0:45:35]: at that time and said this is what they would be able to fit on their site. So yes. Okay, so what I'm understanding is you and I want the po is that there's lists maybe of twenty such items. You choose five of'em. We choose the the f you the staff recommends five or how does that how do we how do they generally choose? They they come up with a site plan and say these are the five [0:45:35, 0:45:48]: The ordinance sets certain requirements based upon the zoning density. Uh if if you h s hit certain threshold of density you you have to add more amenities. [0:45:48, 0:45:50]: Again, um [0:45:50, 0:46:03]: these were items that were discussed at that time and said these would be the ones that would be acceptable as uh alternatives. So what the developer has done is designed based upon these alternatives. [0:46:03, 0:46:12]: and has included these alternatives which would meet the code as it's written if these were alternatives written in the original code. [0:46:14, 0:46:21]: Okay. Yes sir. Good line. Well excuse me a second. I'm sorry, Ms. Robinson. Go ahead, cousin Watt. [0:46:21, 0:46:23]: Tell on the uh room sizes are these [0:46:24, 0:46:25]: Set in stone the uh [0:46:26, 0:46:29]: One bedroom seven hundred square feet and the two bedroom [0:46:29, 0:46:35]: Yes, those have been approved during the zoning sometime or in twenty fifteen. Those were approved sizes. [0:46:36, 0:46:39]: So what we're looking at tonight is just uh [0:46:40, 0:46:43]: just looking at and approving the amenities as planned. [0:46:45, 0:46:46]: Um [0:46:47, 0:46:49]: So the suggested amenities here [0:46:49, 0:47:09]: is beyond what we we we would we would have all seen. Is that correct? We this is something that was internally done or with this. Yeah, typically in in this case, you know, again, as stated, there'll be a list of amenities, the types of approved amenities that can go in into this type of development. You know, this one was a little bit unique in that it is solely a while it is [0:47:09, 0:47:29]: zoned RM, but it's solely for senior senior housing. So there were certain things that likely would not be realistic to have in that in that in this particular zoning. So went through the list, they presented the list, kinda went back and forth on what was acceptable we from a staff standpoint felt was an acceptable list of amenities produced [0:47:29, 0:47:49]: this. Typically what would happen and I think in and subsequent to this rezoning, usually this is just simply fleshed out at the um at the at the staff level. But it just so happened that the verbiage that was included was to go back to mayor and council. I you know at every typically it would be whether it's city or county to go back [0:47:49, 0:48:09]: back and be addressed and and fleshed out during the um at the staff just to make sure that what they're proposing is are those acceptable amenity items. In this case the verbiage is got the way it got listed on the way it was stated was come back and bring it back before the uh mayor and council. So at this point they're they're sitting on go ready to go. [0:48:09, 0:48:10]: But for [0:48:11, 0:48:28]: the final amenities to be approved. Again, we've looked at it and we're fine with them and just w and we were ready to go ahead and and approve them as a staff. As we went back through and looked at the amendments it actually did reflect go back to the council. That's why we came back and brought it on to the to the council for a should be no more than what, seven no more than seventy two. How many units is [0:48:29, 0:48:33]: Is he looking to build anything? Seventy two units. He's gonna do the seventy two units? Yes. [0:48:34, 0:48:38]: with a uh equipment space of twenty by thirty. [0:48:39, 0:48:41]: Outside equipment space of twenty by thirty. [0:48:42, 0:48:46]: Uh, twenty twenty by twenty feet by thirty. I'm looking at the amenities that you guys put on the paper here. [0:48:47, 0:49:05]: Yeah. The playground the equipped playground is twenty foot by thirty foot. And what's going to go in the playground is uh uh an item that the developer decides. It's not something staff typically says, you know, you need to have one swing, one slide, or it might be just fitness equipment outdoors. [0:49:06, 0:49:19]: Yeah. I'm me person I'm just looking at because I'm just looking at the amenities versus seventy two units. What are the ages that you're starting at in in the senior? This is sixty two and up. Sixty two? Yes. [0:49:22, 0:49:32]: And it's it would be deed restricted to you have to be sixty two. It's it's using uh federal funds to uh develop this, so it would be very uh it would be uh [0:49:32, 0:49:44]: governed by the ind the the federal government would regulate exactly who goes in there and how they're cared for and um that's why there were size changes to the rooms and whatnot because they wanted to take the [0:49:44, 0:50:00]: uh space for everyone sitting in the rooms to move them all out into the open space. So that room would just be uh for uh living and then you'd spend your time out with all the other seniors. So it's designed entirely for senior use. [0:50:03, 0:50:06]: My concern is that in the minutes I don't know [0:50:07, 0:50:09]: Enough about what's uh all the w [0:50:10, 0:50:17]: Everything that's going on with this for me personally to make a decision, maybe my other council members do, because if you're gonna have seventy two units [0:50:17, 0:50:25]: I got a m I have a mother in law that's eighty two and she's still driving. I'm saying at sixty two and and you're looking at the amenities, I don't want to have [0:50:26, 0:50:29]: words put down to say we got this and this and this but [0:50:29, 0:50:49]: You know, I could say I got a car, but if it only fits one person I still have a car, but it's called a car. I don't want to have amenities or things going on with this project just to have words down on paper, but it's not suitable. Everything is not suitable together. And I don't know if you've got to do that. [0:50:49, 0:50:56]: They have done a number of deeds about the country. Um so that certainly gave us'cause one of our concerns early on was the issue of [0:50:56, 0:50:58]: Yeah, we've seen a number of [0:50:59, 0:51:12]: developments that started out as senior developments, but over time they transitioned into just regular non senior developments. So they've had they have some track record on what they've done in the past, what they've done, they've developed these these um type structures before. [0:51:13, 0:51:14]: You know, so I [0:51:15, 0:51:20]: They know their market. They're they're they're they're building to a a sp a very a very [0:51:20, 0:51:22]: Distinct market. [0:51:22, 0:51:23]: um and target set. So [0:51:24, 0:51:44]: Yeah, where they've worked, we've gone through, we have looked back in some of the other developments that they've done in other areas and they've had a successful track record. So again that was a concern. We did not want this to be one of those ones that transitioned back to uh from a what started out as a senior develop um community to a non senior development community. So um like I said we've we've seen some other [0:51:44, 0:51:52]: it's it's comparable to what we've seen some from some other um senior developments and I'm certainly trust their market research as far as what's going to be needed. [0:51:52, 0:51:55]: [3116.6, 3128.1]: For me, if it's something's not reached now, if the week this could be changed as a dis to a discussion item so that the twice presented for approval won't be weighed toward that. [0:52:08, 0:52:12]: if this if this be the case, I'm not speaking for anybody but myself. [0:52:13, 0:52:15]: I I would have I have more questions that I would [0:52:16, 0:52:36]: have to look at more and and ask. But me I I can't make a dis I won't be able to make a decision my personal myself but I I do want to say my apologies, this was not presented and discussed at the last meeting we had. I had a family emergency that I had to tend to. So the matters was left uh to the city manager. He is you know obviously Mr Harris is aware of the projects but [0:52:36, 0:52:52]: He's not in the weeds, shall I say, and in detail enough to go into matters like this. So I apologize I was not here at that time. And uh that's why um w you know. [0:52:53, 0:53:02]: trying to prove this in a way that I know they won they would only have twice to come before us on this. Are we can we legally change it to discussion discussion item? [0:53:02, 0:53:13]: Exactly I mean I I'm not speaking for my other councilman, I'm speaking for me personally. Well yeah, I guess we could table it but personally I'm ready to vote on it. I mean that's if it means anything else to the rest of the council, I'm ready to vote on it. I don't need to discuss it at all. [0:53:14, 0:53:15]: I'm I'm ready to go. [0:53:15, 0:53:20]: So but uh anyway any it's a take if they want to vote on it that's fine. [0:53:21, 0:53:27]: You have any additional comments? All right, so if that's the case, no additional comments then then I uh like to ask for a um [0:53:27, 0:53:29]: and actual motion to um [0:53:29, 0:53:32]: to accept uh these um [0:53:32, 0:53:36]: different amenity t uh upgrades, I guess you may say. We like to call them upgrades. [0:53:36, 0:53:38]: uh for this uh [0:53:38, 0:53:42]: Uh senior citizen uh Red Oak Village. [0:53:42, 0:53:43]: Okay. [0:53:44, 0:53:56]: I will um we'll make a motion to approve R Z sixteen twenty uh dash S uh with the recommended uh amenities package. Um [0:53:56, 0:53:57]: Tonight. [0:53:57, 0:54:01]: That should be fine. There you go. Okay. Any further discussion? [0:54:02, 0:54:04]: Okay. If not all all in favor, please indicate. [0:54:05, 0:54:06]: Okay, all polls. [0:54:07, 0:54:12]: Okay, so we got the three zero one. Mayor Protein. For clarification. [0:54:13, 0:54:21]: Um is this attachment two, Dale, or was the one on the um screen a different number because attachment two had two additional items. [0:54:24, 0:54:25]: I'm I'm not sure. [0:54:29, 0:54:36]: Yeah, those those two items under attachment two are not amenities. Those are actually conditions of zoning. [0:54:37, 0:54:41]: Hey, that's what I want to make sure what's been what they're voting on. [0:54:42, 0:54:58]: We voted on the money. And those two items that are listed as their amenities are not amenities. They're [0:54:59, 0:55:10]: Just conditions of zoning. So they were just dropped off of that. So the items that were shown uh are the items that you voted on. Right, which is on uh Tasma two. Okay, good deal. So it's three zero one. [0:55:10, 0:55:11]: On that. [0:55:11, 0:55:12]: Thank you. [0:55:13, 0:55:14]: Um [0:55:15, 0:55:20]: I have next item item number five. Actually the next three items are all dealing with public hearings. [0:55:20, 0:55:27]: a public hearing that is. And so item five would deal with uh RZs that's sixteen, dash twenty, dash S [0:55:27, 0:55:33]: Request City initiated reversion from C two general commercial to RA residential arch agricultural. [0:55:34, 0:55:39]: Profile ID number S two twenty four dash zero one dash zero zero two dash zero zero zero [0:55:40, 0:55:48]: S twenty four dash zero one zero zero three zero zero zero and that's twenty four dash zero one zero zero two zero zero two [0:55:49, 0:55:55]: Location one twelve, one eighteen and one twenty four Old Conyers Road, landlot sixty eight. [0:55:55, 0:56:00]: to the twelfth district proposed use purpose single family residences, two parcels [0:56:00, 0:56:02]: and a bread and breakfast one parcel. [0:56:03, 0:56:07]: Shot uh lot size ten point nine eight acres. Mr. Hall, please. [0:56:08, 0:56:28]: Again, thank you, Mayor Pro Tem and Council. These next three items on the agenda are tied to each other and we'll go through them in order. They'll need to be voted on individually and then uh to to make them all go forward. Again, this is one second, please. On that note, then if they have got to be voted on individually, that means I have the three separate public [0:56:28, 0:56:42]: Okay. That's what I need to make sure I get clarified. Go ahead, sir. Again, I apologize I was not here at the last meeting to present these in detail, but Mr. Harris did a admirable job of presenting to you and I'll be here to answer any questions that you may have on this. [0:56:42, 0:57:01]: Uh the first item is a city initiated reversion. And there are three parcels that were zoned in two thousand seven from an RA residential agriculture zoning to a C two. There was a development agreement put in place on these three parcels that would make a special events occasion um [0:57:03, 0:57:23]: of uh the all three parcels were tied together to create the special events uh area. Um unfortunately that net never materialized and the owner of the three parcels still remained the owner of three separate parcels, but the individual that brought this forth in the zoning who had the development agreement brought forward [0:57:23, 0:57:28]: is no longer part of this situation. So you have three separate parcel owners [0:57:28, 0:57:33]: and a development agreement with another individual that's no longer in the equation. [0:57:33, 0:57:49]: So that being the case, the city has looked at this and said the way to release the property owners from those requirements is to revert these properties back to the original zoning that it was prior to this rezoning of two thousand seven. [0:57:49, 0:57:51]: There are three houses. [0:57:52, 0:57:55]: one house on each of the individual parcels. [0:57:55, 0:58:03]: Two of the houses are presently still being lived in. So you have individuals living in a house since two thousand seven on a commercially zoned property. [0:58:04, 0:58:13]: So to clean up all of this, it's the recommendation of the city to revert these back to the original zoning. I have here [0:58:15, 0:58:24]: an air photo, I'll even go larger, to show where the property is located. This here is old Conyers and this is [0:58:25, 0:58:28]: Old Atlanta Road or East Atlanta Road, and here's the publics. [0:58:29, 0:58:35]: So it's these three parcels of land right behind the publics. The zoom in shows it even better. [0:58:38, 0:58:40]: And you can see that here's the public's parking lot. [0:58:41, 0:58:46]: Here's a drive off to Old Conyers. Here's a lake. There's a beautiful lake on site. [0:58:46, 0:58:51]: This parcel here you'll hear later in the next two zonings [0:58:52, 0:59:09]: This parcel here has a house on it in this area where an individual is still living in it, and this parcel here has a house here and an individual still living in it. There is a driveway along this line right here that's an easement that goes back to this lot and the driveway also comes off this lot. [0:59:09, 0:59:25]: So it's the recommendation of the city staff again to revert these three parcels back to residential agriculture, which would make the development agreement null and void, and then the property owners would have their residential agriculture rights. [0:59:26, 0:59:26]: Okay, thank you. [0:59:27, 0:59:28]: Questions Council. [0:59:29, 0:59:43]: Yeah. So so we do understand uh th the residential agriculture zoning designation that allows the for w where we're trying to go with the bed and breakfast, is that how that works or? [0:59:43, 0:59:50]: the zoning that you have coming up after this would not allow the use as requested by the applicant. [0:59:50, 0:59:57]: Okay, so that's why we're bringing it back to the original RA and now there's going to be another zoning. If the council would not approve [0:59:58, 1:00:06]: uh decides not to approve the rezoning that's coming to you later, then these three parcels just become houses on residential lots, as they should be. [1:00:08, 1:00:28]: Okay, I'm I'm kind of m okay, th the the desire okay, w I'm not understanding w is the desire is to have this is the lot that's was presented to us previously to have the bed and breakfast, correct? Yes. Okay, is that the direction that we're does this take us in the direction that we're going? After the next one, okay, after the next one. Okay. So that's [1:00:28, 1:00:32]: Okay. Alright, well we're good. [1:00:32, 1:00:34]: Based uh file caption. [1:00:35, 1:00:46]: Okay. Yeah, the development to also to allow the applicant that's coming up to do what they want to do, they're bound at the present time, they're bound by a development agreement. [1:00:46, 1:00:49]: that can't be met. [1:00:50, 1:00:55]: We're breaking the development agreement so we can move forward. Okay. Okay, any further questions? Yes sir. Go right ahead. [1:00:55, 1:01:14]: Reverting it back to an RA. So now you have to come back for special bearances, is what you're saying, in order to revert it back to commercial? To rezone it to commercial. Zone it back to commercial. Yes. And that's why we have three zonings back to back to back. The first step is bring it back to RA, uh, which eliminates the development agreement. [1:01:14, 1:01:24]: We're cleaning the slate and now the applicant will rezone it from RA, which you just rezoned it to, if you go forward with this, to the new zoning that it has to be to do what they want. [1:01:24, 1:01:34]: 'Cause initially when we first uh uh uh talked about it I didn't know that this element even existed with the uh two projects. I mean we talked about what are the distances in feet [1:01:34, 1:01:40]: pertaining to the ordinance and various that we have o on on the table. Yes. Pertaining to any [1:01:41, 1:01:53]: uh properties that will be even listed to RAs right now. But this is a new component that's coming up. I have a diagram that will clear that up once we move into that also. So right now if we decide to move to [1:01:54, 1:02:07]: back to RA as staff recommends. There's no setback issues, there's no issues, it's just three houses on residential lots that conform to everything in our code as it presently sits. But that new element with someone is in residence now. [1:02:08, 1:02:12]: How uh is it have we talked to them? I mean what's what's going on with that? [1:02:12, 1:02:21]: They're actually an existing nonconforming uh uh they're nonconforming, whether they're uh [1:02:22, 1:02:22]: Okay. [1:02:26, 1:02:31]: 'Cause they're'cause they're functioning a as a residential in a commercially zoned property. [1:02:32, 1:02:39]: that that's the nonconformance. And so this would clean up that part of it and simply allow them to continue doing what they're currently doing. [1:02:39, 1:02:43]: Um which would be correct function as a residential as a residential parcel. [1:02:44, 1:02:53]: I'm fine with it, but the only concern I have with that is that when we come for the special bearances, now we've opened the door for future projects that will come through. [1:02:53, 1:03:05]: for for special variances if the if the distance between residential homes that have changed are now shortened because of special variances. That's the only concern. [1:03:06, 1:03:18]: consideration for this request and this request only. And again, as we get into that, I I hope to explain how we could proceed in in that matter to address that. [1:03:21, 1:03:36]: A very very good question, and I understand where you're going and I'm I'm anticipating to answer that. Where are we going with this today? Okay. [1:03:37, 1:03:40]: Councilman Blount's asking some good questions, so I mean [1:03:41, 1:03:44]: You're saying it's just for this only? [1:03:44, 1:03:44]: This [1:03:45, 1:03:46]: Property only. [1:03:47, 1:03:59]: Specifically for this property only. This what we're asking for now doesn't change [1:03:59, 1:04:08]: Anything on any of the parcels except for the zoning of the property. It's bringing non conforming use into conformance. [1:04:09, 1:04:12]: People are using people have a zoning on the property that they are not [1:04:13, 1:04:16]: utilizing appropriately. Okay. [1:04:18, 1:04:38]: Okay, look uh because I I probably can't kinda understand where they're going because I had a little zoning experience, is that as a novice I would have been totally confused by this too. But what is really happening is they're they're right now currently it a non conforming usage meaning they're using it in a way that it's not supposed to be used. [1:04:38, 1:04:58]: to be residential. We're changing it back to residential, which will make their use pro appropriate because right now they are residential in a commercial area which it would have been worse for them. So we're taking it step by step to go in that direction. And on that uh note I'd like to make a motion to that yes sir. It's a public hearing. Okay. [1:04:58, 1:05:00]: Okay. Okay. [1:05:00, 1:05:03]: All right, so on the council uh considerations I need to open up the public hearing. [1:05:04, 1:05:07]: Uh so for the citizens that are present [1:05:07, 1:05:11]: Uh this is a public hearing so I'll take anybody that is for [1:05:11, 1:05:19]: this uh reinverting or converting back over and I'll start from my very left. Okay, anybody's for this that wants to speak? [1:05:20, 1:05:20]: Okay. [1:05:21, 1:05:23]: In the middle. Anybody for this is alone to speak? [1:05:24, 1:05:28]: Okay, for this anybody from our far right that wants to speak. [1:05:28, 1:05:29]: All right. [1:05:29, 1:05:31]: If that's the case, then I'll close that out. [1:05:31, 1:05:33]: Anybody that's against this reversion? [1:05:33, 1:05:36]: Okay, from a far left on this side. [1:05:36, 1:05:37]: Wants to speak. No? [1:05:38, 1:05:38]: In the middle. [1:05:40, 1:05:40]: All right. [1:05:41, 1:05:44]: All right. If that's the case, public hearing is now closed on that note. [1:05:44, 1:05:45]: No comments. [1:05:46, 1:05:55]: Now on that note then I would now ask for a motion uh to accept the council excuse me the staff's recommendation to revert this back. [1:05:56, 1:06:04]: Go right ahead, please sir. Uh yes, Mayor Proteum. I'd like to make a motion to approve RZ sixteen nineteen S. [1:06:04, 1:06:05]: Okay, so a second. [1:06:07, 1:06:08]: There you go. [1:06:08, 1:06:09]: Any further discussion? [1:06:10, 1:06:11]: All of those. [1:06:11, 1:06:13]: Okay. Yes sir. Go right at it. [1:06:13, 1:06:17]: So reverting this back, so later on we're gonna get the specifics to [1:06:17, 1:06:30]: Special variances or whatever's going on, whatever we need to discuss in between. Yes. Okay. After as soon as we're done here, these three parcels are now going to be zoned RA, residential agriculture, as they're presently being used. [1:06:31, 1:06:32]: Any further discussion? [1:06:33, 1:06:37]: All in favor of the motion please indicate. Okay, unanimous. Great. Four oh. [1:06:37, 1:06:40]: Now, Mr. Hall, item number six. [1:06:40, 1:07:00]: RZ dash sixteen dash nineteen dash S request rezoning for C two general commercial tools, C three heavy commercial parcel ID S twenty four dash zero one dash zero zero two dash zero zero zero location one hundred twelve old Conyers Road Land Lot sixty date of the twelfth district proposed use perfectly [1:07:00, 1:07:05]: Purpose bed and breakfast lot size three point seven three four acres. [1:07:05, 1:07:07]: Applicant Marvin Johnson [1:07:07, 1:07:09]: Agent Anita Johnson. [1:07:09, 1:07:11]: And Mr Hall, please. [1:07:11, 1:07:13]: Again, thank you, Mayor Pro Tem and Council. [1:07:13, 1:07:14]: This [1:07:14, 1:07:34]: Uh the the applicant is here and will assist in answering questions as deemed appropriate in a few moments, but I want to go on a brief outline of where we're at. Applicant came and wanted to do a bed and breakfast on this parcel. The unique thing about this, this had a development agreement that we just talked about on these three parcels of land for a bed and breakfast. [1:07:34, 1:07:46]: breakfast. That that development agreement could not be uh followed through on and so to have this zoned to a bed and breakfast, the property needed to have appropriate zoning. [1:07:47, 1:08:02]: Um the appropriate zoning for this property it would be C three. Our code as it is presently written does not have the term or definition bed and breakfast. So staff would staff is looking at bed and breakfast to be a hotel. [1:08:03, 1:08:23]: That's the closest that we have with that. To have a hotel it has to be in a C three zoning. That's the heaviest commercial that we have. C three also allows for a lot of other uses, commercial uses that might not be advantageous to put in that area. Um heavy automobile chain you know, things like [1:08:23, 1:08:30]: that uh working on engines and things. So what when this came through for ZAB, uh [1:08:30, 1:08:39]: And this came through just in July. It was recommended to have approval of this with six conditions, and I will go through these six conditions. [1:08:39, 1:08:48]: One, the only allowable C three use on the subject property shall be limited to bed and breakfast, which eliminates that concern that I just mentioned. [1:08:49, 1:08:56]: Uh two, the number of bedrooms shall be limited to six. That's the number of bedrooms that's currently in the building as it exists. [1:08:56, 1:09:12]: Use of the subject property for recreational activities and weddings shall be permitted. Staff does have a concern about the term recreational activities and we believe that maybe social events or another term should be used instead of recreational activities. [1:09:13, 1:09:30]: four. Sixty feet of right away from the center line of old conjures is required to have preserved to the site side along the subject properties frontage, any new facilities shall have a building setback line based upon the preserved right of way line location, and I'll explain that with a diagram. [1:09:30, 1:09:50]: Any new development on the site will require improvements to or replacement of the existing driveway. Any new or relocated curb cut onto on cup onto old Kiners Road shall be located in such a required buffer as preserved and at the minimum intersection site distance is met per the road's posted speed limit. The developer owner shall coordinate with the city of [1:09:50, 1:10:10]: Stockbridge and Henry County DOT concerning requirements related to the relocation of the driveway and any additional requirements that may be required along the relocation of the driveway, including but not limited to providing a buffer, constructing an acceleration taper, deceleration lane, etcetera. What number five says basically is if there's any site improvements or changes. [1:10:10, 1:10:18]: changes to the external side of the site or the building and the driveway changes, it needs to get all approvals that are required in the code. [1:10:18, 1:10:20]: I mean it's long winded, but that's what it says. [1:10:21, 1:10:32]: And number six, for any commercial development of the site aside from the bed and breakfast, there may be additional excess related requirements imposed by the City of Stockbridge and the Henry County. [1:10:33, 1:10:35]: Okay? Now, if I go to [1:10:38, 1:10:39]: The site [1:10:40, 1:10:41]: We have these three parcels. [1:10:42, 1:10:45]: This one is actually [1:10:47, 1:10:48]: The front red parcel. [1:10:50, 1:10:53]: Okay? So that's where this site will be located. [1:10:54, 1:10:56]: There is a house on the site? [1:10:57, 1:11:01]: There's a driveway that comes and there's a a small building here. [1:11:04, 1:11:06]: Bear with me again as I move on to another [1:11:07, 1:11:16]: Drawing. And this what is intended to but one s one second, please. Those six you just ran off. I don't s do we have that? I don't see it in a [1:11:16, 1:11:25]: Do we hear that? It it is in the Henry County staff recommendations. I don't have that section in front of me. [1:11:25, 1:11:28]: Conditions, yes, on this basis. [1:11:28, 1:11:39]: Yeah, I apologize for that. Those those are on page five of the Henry County ZAB meetings report. Okay, thank you. Sorry that. [1:11:39, 1:11:40]: Yes. [1:11:44, 1:11:47]: So again, that is what's brought forward tonight. [1:11:49, 1:11:51]: in this section. Now [1:11:51, 1:11:57]: Keep in mind there are variance requests that's coming right after this which pertains to this site also. [1:11:58, 1:12:01]: As it sits right now, it this was to be zoned. [1:12:02, 1:12:18]: to C three with conditions, there would be some main there would be some restrictions on how they could develop this in the future or move forward. The intent of this is to utilize the facility as it sits presently. [1:12:18, 1:12:27]: not adding to the buildings besides updating for building code requirements and ADA accessibility and fire code requirements. [1:12:28, 1:12:30]: Okay. There are no other [1:12:31, 1:12:37]: expectations or requ or desires for the applicant to do at this time. [1:12:37, 1:12:57]: Now for building and code requirements there would be driveway updates, parking lot updates, buffer issues to be addressed. And those are all to be set forward in the variance application also. So if for the developer to move forward and do what she is asking [1:12:57, 1:13:00]: the variances would need to be addressed also. [1:13:02, 1:13:10]: So if the variances are not addressed in the in the manner that she's looking, she would have to do some uh site updates to the existing facility. [1:13:11, 1:13:12]: Okay. [1:13:14, 1:13:15]: Questions, Council. [1:13:17, 1:13:37]: I'm right here. I just I think d to cut down to the c um the short of it is that pretty much you're setting it up as a s as a C three, but basically that is the restriction. At C three that is the only you only allowable use would be for a bed and breakfast. So there's no potential of something else coming in and [1:13:37, 1:13:57]: And assuming that the zoning the zoning would go forward with the property um should this uh tenant decide to sell it and all of the above or how does that work? Does it revert the zoning condition says C three for bed and breakfast only. That would not allow a jiffy lube to come in in the future or something else at the time. Now if the [1:13:57, 1:14:03]: Uh if the council deems it appropriate they could say the only C three use can be bed and breakfast. [1:14:04, 1:14:13]: other C two or C one uses could be considered and that would be up to the the council. It is shown on the uh comprehensive [1:14:13, 1:14:18]: plan that this area alongside uh in that intersection would eventually be commercial. [1:14:20, 1:14:22]: Okay. Any questions? [1:14:23, 1:14:27]: That's what Robson. Sorry. So on here, she's the owner of the property? [1:14:27, 1:14:29]: Or she leaks the property. [1:14:29, 1:14:37]: I would have to check the file specifically. The applicant is here to answer direct questions if you wish to. [1:14:39, 1:14:41]: Understand we can do all that. [1:14:42, 1:14:49]: So you want you want that answer that question comes forward? So can't that. Can she can't she come forward and answer the question, please? Okay. [1:14:51, 1:14:54]: Does it serve right? [1:15:03, 1:15:07]: yourself and your address for the record of the previous week. [1:15:08, 1:15:11]: My name is Anita Johnson. Good evening, by the way. Good evening. [1:15:11, 1:15:17]: My name is Anita Johnson. Uh my address is one seventy Palisade Point Drive, Ellenwood, Georgia. [1:15:17, 1:15:18]: Okay. [1:15:18, 1:15:37]: Ms. Robinson had a question uh pursuit. I was looking um thank you, Mayor Pro Tem. I was looking at page four four of nine and it was stating that um you indicated that you're not the owner of the property, but you're leasing it? Correct. Okay. I mean I I'm is that something that is standard that you can do that? [1:15:38, 1:15:49]: As as an applicant as long as she has authorization from the property owner to do what she's proposing to do. And we have documentation of that from the property owner as well? [1:15:50, 1:15:54]: We do. Yes. Okay. [1:15:59, 1:16:04]: I missed it. [1:16:05, 1:16:07]: Right. [1:16:08, 1:16:11]: And that's that's fairly common, you know, often [1:16:13, 1:16:33]: In some cases you may have a lease contingent upon the zoning, the subsequent zoning based on what it is they want the final use to be. So quite often we'll see the applicant or whoever wants to do the business to come in and actually make the application. They have to just provide a letter from the owner stating that they're aware this is proceeding forward. So that's been checking that [1:16:33, 1:16:37]: We had that information than the other thing. Okay. [1:16:38, 1:16:43]: Since Ms. Johnson is at the Podium Council, do you have any questions pursuing for Ms. Johnson or off? [1:16:45, 1:16:47]: Uh no, I think we talked to you. [1:16:48, 1:16:48]: All right. [1:16:50, 1:16:50]: Okay. [1:16:51, 1:16:54]: So on that note, um this is also a public hearing. [1:16:55, 1:17:01]: Uh f before I back back on, let me s anybody else have anything for Mr. Hall before we go into public hearing, please. [1:17:01, 1:17:07]: Uh really quick. Uh uh it was questioned about making this property about [1:17:07, 1:17:08]: Any other [1:17:08, 1:17:10]: occupants would be bed and breakfast. [1:17:11, 1:17:27]: Um I wouldn't want that to be continual. I like it to be whoever comes in as another bed and breakfast, I guess, that we would deal with that person on an individual basis. Because the amenities that you provide or whatever could be different from what someone else would bring in to just say we'll just allow another bed and breakfast. [1:17:27, 1:17:41]: Not the zoning. This is uh the the accounts approval of the bed and breakfast itself going in on what the amenities are. Because you came before us and [1:17:41, 1:17:48]: presented it to us what y you was doing with the bed and breakfast. How you know, the others so I wouldn't want to just say [1:17:49, 1:18:09]: Okay, bed and breaks move out and just move in. And then they were ha you know as long as they met the same criteria. Right. Right. And and what I was going to the direction I was going is zoning is specific to the property and regardless of whoever owns the property on down the road, they would be bound by whatever conditions of zoning that the city council puts on it. [1:18:09, 1:18:10]: So if you say [1:18:10, 1:18:12]: C three for bed and breakfast only. [1:18:12, 1:18:18]: ten years from now, if no one does anything for the property, it's still C three for bed and breakfast only, regardless of who comes in. [1:18:20, 1:18:20]: Okay. [1:18:21, 1:18:24]: On that note, I'll open up for a public hearing and so [1:18:25, 1:18:43]: Uh this will be uh for the rezoning issue, yeah, rezoning uh C two general commercial to C three heavy commercial for purposes of having a better breakfast on this property. So I'll start this is for in favor. So I'll start on my far left side. Anyone over here? Any comments? Seeing none. In the middle. [1:18:44, 1:18:45]: Um far right. [1:18:46, 1:18:47]: Uh okay. [1:18:48, 1:18:51]: Anybody is opposed to this rezoning process. [1:18:51, 1:18:52]: From the left. [1:18:53, 1:18:54]: The middle. [1:18:55, 1:19:02]: Right. Seeing none. Public hearing I'll close that. Okay. On that note, any other council members have anything else for [1:19:02, 1:19:04]: Um Dale or Miss Johnson? [1:19:05, 1:19:07]: [4747.5, 4754.3]: to accept the staff recommendation to rezoning from C two general commercial to C three heavy commercial for the purpose of having a brand breakfast. [1:19:15, 1:19:16]: Yeah, Protean. [1:19:17, 1:19:18]: Mr. America, what do you think? [1:19:18, 1:19:24]: Mr Mayor Proto, just a clarification. By virtue of the prior action it is now an RA. [1:19:25, 1:19:26]: Oh. [1:19:26, 1:19:27]: Excuse me. [1:19:28, 1:19:28]: All right. [1:19:29, 1:19:39]: Neither neither okay. So from general commercial to wait a minute, no. R from R A from R A to uh C three heavy commercial for the purpose of the bread and breakfast. [1:19:40, 1:19:43]: Okay. So I need a motion to indicate that please. [1:19:43, 1:19:44]: Casual. [1:19:44, 1:19:55]: Mayor Pro Tem, I make a motion to um request that we do the rezoning from R A to C two general commercial from [1:19:55, 1:19:58]: General commercial to C three. [1:19:59, 1:20:00]: Parcel. [1:20:01, 1:20:05]: I D S twenty four zero one zero zero two zero zero zero [1:20:06, 1:20:06]: [4806.8, 4807.8]: Bed and breakfast. [1:20:08, 1:20:08]: Okay. [1:20:09, 1:20:12]: One second. I got a motion. Is it going to be seconded? [1:20:12, 1:20:13]: Circuit. There we go. [1:20:14, 1:20:23]: Go right. Yes sir. It would be staff's recommendation to approve the conditions of zoning that were recommended. [1:20:23, 1:20:30]: With the slight change at number three, the words recreational activities change to social events. [1:20:32, 1:20:41]: Because recreation recreational activities could mean a lot of different things and social events is is is a directed to something else specifically. [1:20:41, 1:20:47]: So it would be a slight amendment to the uh recommendation that has been motioned and seconded. [1:20:48, 1:20:50]: All right. So to do that [1:20:51, 1:20:54]: The recommendation would have to come from the initial person that did a motion. [1:20:55, 1:20:58]: And then she accepts the recommendation, that's acceptable. Okay. [1:20:59, 1:21:12]: Do you accept the recommendation? I accept the recommendation. Okay. Heavy commercial. Okay. Thank you. [1:21:17, 1:21:28]: Thank you. Okay. And then the you accept the recommendations from the staff. Okay. And um I will say that the clerk has that written down? Yes, sir. Okay. All right. Now [1:21:29, 1:21:32]: So it's been motioned and seconded and so any further discussion? [1:21:33, 1:21:35]: Motion was it was a second. [1:21:36, 1:21:52]: Uh well I will second though. Well I thought you did second that. You didn't. Okay, excuse me. I need a motion second then. Excuse me. I thought he did. Right. Okay, I thought so. I told him to stop trying to get a second. All right. Okay. Okay, we're good. [1:21:52, 1:21:56]: We're good. We're having fun. All right. Now, any further discussion? [1:21:56, 1:21:57]: All right. [1:21:57, 1:21:59]: All in favour of the motion please indicate. [1:21:59, 1:22:01]: All right, you dance this is. All right, good deal. [1:22:01, 1:22:02]: As we move on. [1:22:03, 1:22:09]: Thank you again. I I can say in my twenty plus years of planning and zoning, sometimes you come across some issues that are um [1:22:09, 1:22:15]: unique and this is a d a different one. We just thank you for rolling with this and working at a number seven. [1:22:16, 1:22:36]: It's uh deals with uh VR dash sixteen dash one zero dash s variance request. Parcel ID S twenty four dash zero one dash zero zero two dash zero zero zero location one twelve O Conyo's Road Land Lot six date to the twelfth district proposed use purpose bed and breakfast lot size [1:22:36, 1:22:45]: size three point seven three three four acres applicant Anita Johnson slash uh J S venue plus Mr. Hall please [1:22:46, 1:22:51]: Again, this is the same uh site that we looked at previously. [1:22:52, 1:23:12]: It was uh written by Henry County the report was written by Henry County Planning Staff and they recommended denial of the four items that were requested by the applicant. I will read these off and then I have a diagram which explains these in more detail and we'll we'll go into a larger explanation. The first one is reduce the [1:23:12, 1:23:17]: perimeter buffer requirement from fifty foot to forty foot, as was mentioned earlier. [1:23:17, 1:23:27]: two, reduce the required parking from one space per unit plus one per two employees to the existing number of spaces. No additional spaces are proposed by the applicant. [1:23:28, 1:23:31]: Three, eliminate the loading space requirement. [1:23:31, 1:23:39]: Four, eliminate the stream's buffer requirement and impervious surface setback. Allow the state's requirement of twenty-five foot to govern. [1:23:41, 1:23:54]: What the applicant is doing is because this is C three with the intent of a hotel, there are conditions in our building codes that set certain thresholds and certain requirements. [1:23:54, 1:24:04]: Being that we don't have bed and breakfast in our code, she's asking for relief of some of these which is m which are more conducive or would be more conducive to the use that she is proposing. [1:24:05, 1:24:12]: So that being said, again bear with me as I flip around here and change to this diagram here. [1:24:18, 1:24:19]: Okay, here we go. [1:24:21, 1:24:22]: This here [1:24:23, 1:24:24]: Is [1:24:25, 1:24:30]: the site as it lays out presently. It's that same triangle piece as we saw. [1:24:31, 1:24:32]: earlier. [1:24:33, 1:24:35]: The forty foot setback [1:24:35, 1:24:44]: The C three requires fifty foot setback from structure to property line if it is adjacent to a residential [1:24:45, 1:24:45]: parcel. [1:24:46, 1:24:52]: This is now a C three parcel that's adjacent to a residential parcel, so there's a fifty foot required setback. [1:24:53, 1:24:58]: The building as it sits on the lot presently is forty foot from the property line. [1:24:59, 1:25:06]: So for the applicant to continue the use of the building as it sits, they would need a variance two forty foot. [1:25:06, 1:25:12]: And staff believes that's a reasonable request for that. You can't up and move the building ten feet. It just it's hard to do that. [1:25:13, 1:25:24]: The second one that is reduce the parking required. This is the existing drive that's to the building as it sits on the site. Remember it's a six [1:25:24, 1:25:27]: Approximately a six bedroom house, frame house. [1:25:28, 1:25:40]: There are parking spaces along in here for a few parking there. I think there's two or three along in here. There's a garage here that you could put two or three in, and there would be two parking spaces right in this area. [1:25:41, 1:25:43]: So that's a total of, I believe, six [1:25:44, 1:25:54]: par six parking spaces. And the applicant is here to explain this in more detail. The applicant's looking for a request of that because again they're not looking to do any changes to the site. [1:25:54, 1:26:09]: They're looking to keep it a residential atmosphere and whatnot. Staff does have a concern with that because in discussions with the applicant, if this is going to be used as a bed and breakfast and an events site, social events site, you could have [1:26:09, 1:26:11]: Hundred people at this site? [1:26:11, 1:26:12]: Where would they park? [1:26:13, 1:26:30]: Well the applicant has worked with surrounding communities, the church across the street, with publics, and with the Cochrane Park down the road, so people could park and walk to this area. Okay? Or be shuttled in or however it may be. Now my concern with the shuttling in was there's no [1:26:30, 1:26:31]: Turn around. [1:26:32, 1:26:34]: If you're using the existing drive, there's no turnaround. [1:26:35, 1:26:42]: So that would need to be addressed. Also, the sidewalk as shown on this gray line here ends right at this point. [1:26:43, 1:26:51]: Now there is a gate right here on the site and there is a a trail that goes through this site through the backyard into the frame house. [1:26:52, 1:26:59]: But still if even if the individuals parked off site, that is a long walk to this facility. [1:26:59, 1:27:08]: So staff has a has a concern that there is no parking sp on this site, but you don't want to end up putting [1:27:08, 1:27:14]: parking for a hundred people either because then you're taking away the residential feel of the bed and breakfast. [1:27:15, 1:27:18]: So what staff is shown here is in this area here where the circle is [1:27:19, 1:27:22]: This is an open space area which does flood. [1:27:23, 1:27:36]: when there is water through here, it all gathers in this area and then comes down this drainage and into here. There could be maybe design some type of turnaround area, drop off area that would be more conducive to the social event type [1:27:37, 1:27:44]: issues. I talked with the applicant about that today and the applicant has some concerns with that and I'll let her address those uh with you directly. [1:27:45, 1:27:47]: So that was item number two. [1:27:47, 1:27:50]: Item number three is eliminate the loading space requirement. [1:27:51, 1:27:56]: A hotel requires a loading space to deliver the foods and all the things to go. [1:27:56, 1:28:13]: I'm not sure this building necessarily needs one because uh but it would need area for cars to come in, turn around and whatnot, which again would lead back to the drop off expansion area, would be a good use. And then the last but not least is number four, and that's right here. [1:28:13, 1:28:22]: There's a metal building existing on the site and the applicant has some ideas of maybe putting this into uh making this another um [1:28:22, 1:28:42]: use for w uh a bedroom or something, the honeymoon suite or something, it would need some significant upgrades that would need to meet building and fire codes. Those are not a concern of city council. That would have to be addressed through the planning and zoning or for b the building department. But this building as it sits is not seventy five feet away from [1:28:43, 1:28:44]: The lake. [1:28:44, 1:29:04]: Our code requires it to be. So for it to be used or upgraded to add in maybe a a restroom or something and put in make it nice and cozy inside, it is twenty-five feet approximately, which is out of the state requirements. They're asking for us to be lenient on that seventy-five foot to just stay within the requirements. [1:29:04, 1:29:09]: requirements of the state. And again, staff believes that is a reasonable request. [1:29:09, 1:29:20]: Keep in mind that all of these requests by the applicant are only allowed or only would be permitted if the applicant does no external development on the site. [1:29:21, 1:29:23]: So if the if they decide to [1:29:24, 1:29:25]: Add another wing to the building. [1:29:26, 1:29:27]: They lose all of these [1:29:28, 1:29:34]: variances. If they decide to, you know, add uh f something else to the site. [1:29:34, 1:29:40]: the turnarounds and drop off and expansion expansion areas and maybe uh [1:29:41, 1:30:01]: made paving or impervious areas would not trip the threshold of losing these variances because it would be part of the the agreement with tonight. So these are the four items that are brought before you tonight. And again we'll need some discussion on this. I realize this is the first time we've gone in depth on this. This might be an item that you could we could answer as much as possible tonight. [1:30:01, 1:30:02]: But if not [1:30:03, 1:30:07]: It's up to your uh purview of whether you wish to push this forward to another date. [1:30:08, 1:30:20]: Okay. Council, any qu specific question for Dale first. For Dale first. We'll get to the advocate in a second. No, I think the advocate can help us so. Okay. All right. All right. Ms. Johnson, I need you to come forward, please. [1:30:29, 1:30:49]: All right, Ms. Johnson. We got a bunch of questions for you. Yes, I'm sure. You want to start, sir? Go ahead. Yes, sir, I will start. In our previous conversation, I believe you did allude to the fact that there w there would uh be some re you have two facilities, there's one in Morro, right, and then there's one here, and that um you would not be using this [1:30:49, 1:30:55]: particular location for receptions, I think, or or one of the above. Could you c talk about that a little bit? [1:30:56, 1:30:56]: Yes. [1:30:57, 1:30:57]: Um [1:30:58, 1:31:04]: You are correct in what you recall. Uh let me say this that our long term goal [1:31:05, 1:31:06]: is to [1:31:07, 1:31:27]: lease property at the public shopping centre located directly next to this property to be able to host receptions. That's our long term goal. Uh during the interim at least a year or two really it hinges on the success of um us doing events on the facility. And [1:31:27, 1:31:47]: Events really we're specifically targeting weddings because we currently do weddings at our facility in Morro, but they're all conducted inside. So this will give us an outdoor opportunity to extend to our clients. So we're primarily looking to really test the [1:31:47, 1:32:07]: event side the bed and breakfast is a go is totally different from the event side in in my opinion. Um so for weddings these clients will only come to the property, will not enter into the house or anything at all. They will come to the property, uh there's an area, cazebo area [1:32:07, 1:32:27]: uh located closely to the lake is where the wedding will be held on grounds. We'll be able to specify we've been in business for 13 years, doing events for a long time. One thing we do know about events, one thing we have learned is to put some controls in place. [1:32:27, 1:32:47]: So for those booking this facility for weddings, we will specifically indicate up front and ask the client to indicate on their invitations or whatnot, there will be walking involved. So people can kind of make a decision early on whether they want to participate or whether they will wait. [1:32:47, 1:33:07]: Back at the facility to join the crowd for the reception. So, yes, reception will be currently held in Morrow at our facility there, which is about 20,000 square feet of space. So to make the transition easy for our clients, we wanted to handle the [1:33:07, 1:33:27]: the transportation piece to get them from one location to another'cause typically for weddings you lose people if they're having to travel on their own if the wedding is in one location and ceremon uh excuse me reception is in another. So that's how the busing comes into place. We're trying to handle [1:33:27, 1:33:32]: that piece and make it a little um smoother for the client. [1:33:34, 1:33:38]: My my question you s you say you've been for thirteen years have you done [1:33:38, 1:33:41]: Bed and breakfast for thirteen years or events for thirteen years? [1:33:42, 1:34:02]: We've done events w we're officially an event center and a tr traditional travel agency is what the business is. So we haven't directly done bed and breakfastes, but on the travel side, um we often deal with bed and breakfastes and other hotel [1:34:02, 1:34:22]: accommodations as well. Also we're kind of unique from some other event centers because we do both travel and we do events and we mix travel and events together a lot in what we do. For for an example, in the weddings that we currently offer, we don't only rent the facility [1:34:22, 1:34:42]: to our clients, but we're full service. We take care of everything they need for the facilities, dressing it with linens, decorations. We also do some outside things. We take care of their limo, we accommodate them on their uh wedding night, uh, and we partner with hotels and go in and deal with them in dress rooms. [1:34:41, 1:34:47]: rooms and get it ready for them uh at night. Also we do their honeymoons as well. [1:34:47, 1:34:50]: The r the reason I'm asking this is because [1:34:52, 1:34:54]: When this was first brought to us [1:34:56, 1:35:03]: I my assumption was that you this this wasn't the first bed and breakfast that you're gonna be doing. Oh. And when it was brought to us [1:35:04, 1:35:06]: the element of events now. [1:35:06, 1:35:08]: supersedes bed and breakfast. [1:35:08, 1:35:21]: because now we're asking for special bearances by the house the the metal building on the lake from seventy five feet to twenty five feet and then we're asking for because even now with events you have nothing in place [1:35:22, 1:35:27]: right now in writing to say I have this in place for parking for events. [1:35:27, 1:35:33]: And now it's more geared toward events than bread bed and breakfast. And that's kind of a concern to me because [1:35:34, 1:35:37]: you know, you can do events for thirteen years. [1:35:37, 1:35:38]: But [1:35:38, 1:35:42]: running a bear and breakfast seems to be secondary to what you're doing right here in the city. [1:35:44, 1:36:04]: If I can answer. Bed and breakfast will be the primary use of the property. Although I have not owned a bed and breakfast, I've managed a hotel for seven years in the city of Morro. So I'm very familiar with facility management, maintaining properties. Uh this property is very conducive to a bed. [1:36:04, 1:36:24]: Bed and breakfast. And again, it it the primary use of the property will be a bed and breakfast. Actually, we will be I will be residing on property as well to be an innkeeper. So we'll be very in touch with the bed and breakfast side. The event side is just an [1:36:24, 1:36:26]: add it um [1:36:27, 1:36:36]: source of revenue, if you will, to the bed and breakfast. And the event side, we're not talking about w we're wanting to keep it [1:36:37, 1:36:57]: residential in nature. So we're not talking about having outdoor parties, move mo you know, music pumping and you know, a whole lot of activity. We're really only talking about offering the residents of the bed and breakfast uh the opportunity to have social [1:36:57, 1:37:14]: [5834.5, 5853.8]: What you have now, how many other facilities do you have now that you operate? Is it just that one tomorrow? Correct. But the one tomorrow, do you do outside weddings or this would be this would be conducive to have outside weddings? We do inside weddings. So this would be conducive to have outside weddings. It gives you another component toward events. [1:37:34, 1:37:36]: Correct. [1:37:38, 1:37:46]: Yeah, go right in. I guess my only concern was the parking. Um I know you were saying the park area and then you had the church. [1:37:47, 1:37:50]: But then we also have the public, so I just didn't want it to [1:37:50, 1:37:51]: you know, interfere. [1:37:52, 1:37:55]: with the businesses, with the parking. Um so that's something that [1:37:56, 1:38:16]: I'm more so concerned about but see how we're gonna do that. Right. Um'cause you know when you have events if you don't have people staff uh out there you'll tend people will tend to park anywhere. Exactly. And again that's that's what I mean by putting some controls in place. What we what we have put in place [1:38:16, 1:38:36]: So what we have put in place and did early on is an agreement with us and the church directly across the street and with the county park down the street and still working with publics as well. [1:38:36, 1:38:45]: well to confirm that arrangement. But again what our plan is is to bust them, you know, to the facility um [1:38:46, 1:38:49]: mainly the church across the street. [1:38:50, 1:39:10]: pulling the bus into the church parking lot and letting them um walk across the street. But we plan on having um cross guards, we plan on having um security, might be security or the Stockbridge police. We plan on having their assistance, they're available [1:39:09, 1:39:29]: To help people cross the street, not just really leaving it to them to, you know, get across best they can. We plan on offering that assistance. Also, we plan on doing some small shuttling, and I'm saying small shuttling a minivan, something that can fit into the driveway of the bed and breath. [1:39:29, 1:39:39]: office that will pick up those people at the parking lot who may not be able to walk the distance and drive them across the street to the house. [1:39:41, 1:40:00]: Okay. I do not for publics. I do have written agreement with um [1:40:00, 1:40:20]: the county park as well as the church across the street. The other concern is about the turnaround area that mister Mr Hall mentioned. I guess you all talked about that. It's somehow indicated uh don't want to put words in his mouth it kinda floods sometimes when water uh when it rains, it runs down. We y gotta make it more of a solid surface I would imagine or or [1:40:20, 1:40:40]: Well we really don't want to do anything with that. That is what um Mr. Hall is proposing. We really don't want to have to put a turnaround area on property. We feel that you know providing the parking across the street and assisting our clients with getting across the street will be sufficient. [1:40:40, 1:40:52]: efficient. And then two, we're only looking to have to do this, uh perhaps if the event side proves to be successful, we only hope to be doing this a year [1:40:52, 1:41:12]: maybe two max. The long term goal again will be to rent space at the public shopping center which will eliminate the buses at least having to drop people off. People will park then at the parking uh shopping center and parking where the public's parking [1:41:12, 1:41:21]: It has a sidewalk that leads right up to the gateway that walks around the lake to the area where the wedding is gonna be held. [1:41:22, 1:41:23]: So it'll be [1:41:24, 1:41:38]: So is it adequate like eight feet, ten feet, concrete path, sidewalk? Is that what is that the path you took? It is not currently concrete, no sir. It is a very defined trail though, but it's it's all um [1:41:39, 1:41:49]: I would say dirt and wood. Okay. What do you call the mulch maybe? Yes. All right. Mm-hmm. All right, thank you. Questions down here? Any more questions? [1:41:51, 1:41:51]: All right. [1:41:52, 1:42:00]: Then so uh no mo no more questions for Miss Johnson. Any m any questions for uh Dale? And this is actually for a public hearing as well. [1:42:00, 1:42:01]: Okay. [1:42:01, 1:42:03]: All right. Yes yes, sir. [1:42:03, 1:42:05]: Yeah, Dale, on this property [1:42:05, 1:42:07]: When when we when we look at [1:42:08, 1:42:09]: the uh parking. [1:42:10, 1:42:11]: Obviously this can become a [1:42:11, 1:42:13]: Interesting problem. [1:42:14, 1:42:18]: in not having anything and writing showing that for events [1:42:18, 1:42:20]: that this part is going to be in place. [1:42:21, 1:42:22]: What would you suggest? [1:42:24, 1:42:31]: Again it's not a good idea. [1:42:31, 1:42:43]: This is one of those unique uh planning situations that comes through. My recommendation is to require a site this site to get a special events permit from the city. [1:42:44, 1:43:04]: when they have these events, which would then be each one of those events you would have to review the parking requirements to make sure everything is in order at that time. Make sure there is a crossing guard that has been contracted. Make sure that there are certain uh restrictions put in place. So we do have a special events permit application process right now. [1:43:03, 1:43:07]: So this is as it sits right now, this is [1:43:08, 1:43:10]: a bed and breakfast that can do some social events. [1:43:11, 1:43:27]: but how big those social events are, see how these start to roll into each other. So that would be my recommendation that something to the effect of uh parking issues will be uh or or parking is approved as existing on the site. However [1:43:27, 1:43:37]: social events will require a special event permit. I would I would like for this to be approved or on those contingencies that each event be approved because that [1:43:37, 1:43:45]: that can be a that can become a interesting problem uh for this property. Those contingencies need to I I think need to be put in place. [1:44:01, 1:44:21]: Okay, any other questions from the council? Yes. Okay, right here, please. First of all, I would like to know if the applicant is agreeable to these terms um with the uh special events. Uh is the applicant agreeable to the terms that Mr. Uh Blount suggested we only put words in your mouth uh and at the and at the same time I kind of see [1:44:21, 1:44:40]: See where you're trying to go, which is there's a lot of empty vacant space at Publix. So if we if this were to be very successful, that would uh fill up some of those empty locations and be in um you know helping this what we can to be business friendly. But I would like to know [1:44:40, 1:44:45]: Uh that sound ver that sounded very reasonable. So are you agreeable to that? [1:44:46, 1:44:58]: Uh I'm not very familiar with the requirements for special event permit, just what um Mr. Hall has shared with me and it sounds like something we can work with, yes, definitely. [1:44:58, 1:45:03]: Okay,'cause I I w if we would do that, we would condition this to require that. [1:45:05, 1:45:06]: Yeah, [1:45:11, 1:45:22]: [6325.8, 6345.8]: We're we're discussing with the applicant right now what a special event permit is and I'll say it for the public here. A special event permit requires the applicant to basically outline the r what they're looking to do in that location. We have them for neighborhood parties and we could do them uh you know, we have them for a l a lot of different uh uses. [1:45:45, 1:45:49]: But it it requires the applicant to again describe the use [1:45:50, 1:46:10]: put together the number of individuals they expect and then to show how they're going to address those individuals with parking and if they are going to utilize off site parking, how they're getting people from point A to point B, and then also requires them if there's uh traffic issues that they will have to get with the police department and do traffic [1:46:10, 1:46:22]: traffic routing and all of this. So it's what we do for all of our special events. But since this is a a unique situation, it would be a requirement for any special events at this site to go through our normal review process. [1:46:23, 1:46:36]: Okay, go ahead. Um I just wanted to add um what councilman Alexander was saying, stating with parking, they'll isn't there a automobile or like a oil site there?'Cause I know they use up a lot of the spaces [1:46:36, 1:46:37]: and the publics. [1:46:38, 1:46:58]: So I I do like how we're trying to put something in place, you know, when you're having the events because those spaces are filling up based on that business that's there now. Yeah, there there are some businesses there right now and when you have a special event you need to get a approval from the area you're looking to park at. So publics [1:46:57, 1:47:17]: The the owner of the develop the owner of the shopping center, not necessarily publics, it's another company, but the owner of that development company would have to give approval for her to utilize that parking for that certain day for that certain amount of time. Walmart does it for all of their events like the fireworks and things displayed, they have to come in and get a special events permit because they're taking up certain numbers. [1:47:17, 1:47:19]: Murder parking spaces. [1:47:20, 1:47:22]: [6443.0, 6448.8]: Don't get me wrong, I I'm for I'm for businesses coming to and and people entrepreneurship coming here. [1:47:29, 1:47:30]: My only concern is that [1:47:31, 1:47:33]: When we talk about publics, when we talk about [1:47:34, 1:47:35]: Um whatever parking. [1:47:36, 1:47:38]: We're talking about property you don't own. [1:47:38, 1:47:45]: Mm-hmm. We're talking about property you don't lease. So your d your condition for parking is always contingent on someone else's decision. [1:47:46, 1:47:48]: And that's what that's the concern that I have. [1:47:48, 1:47:55]: With with that being with that being a part of it, that you y your parking would could be contingent on someone else's decision. [1:47:56, 1:48:14]: Yes, I I do totally understand what you're saying. And um I'm okay with providing and I apologize I don't have it tonight, um but providing you with that written agreement that I have with uh Clayton Parks uh excuse me, I'm sorry, not Clayton. [1:48:15, 1:48:31]: Cochrane Park, uh as well which is operated by the county, and with the church across the street to give you some comfort and knowing um I'm not just talking. We do have this agreement in place. My uh initial um [1:48:32, 1:48:52]: plan was to get that agreement also with Publix. But Publix is to be very honest, um Publix Publix is not interested in d doing business with small businesses such as mine. They will only fully commit from what they told me if I lease the space there at Publix. [1:48:52, 1:49:12]: So I do not have that agreement and will not have that agreement until we get to that point. We've just made a business decision to not commit to uh that type of agreement uh which is owning another property or leasing another property until, you know, we've done our due diligence [1:49:12, 1:49:32]: and can show some profit and know that we're able to maintain that facility. So we have gone around publics. Uh also what we've done though is talk with other businesses there um on that property, the auto one and the parking lot sits empty actually most of the time. [1:49:32, 1:49:52]: And so does the um property owners. We've been in touch with the property owners and the property owners are leasing the space to Publix, but Publix has a condition in their lease that requires them to come back to them and get some agreement if they're gonna allow other people to part. Well right now you [1:49:52, 1:50:12]: We currently have other organizations that are using that that public shopping center as a drop-off point or a meeting point, but customers of the shopping center are very few. So the businesses though in that shopping center that are located on the end of where our property is located. [1:50:12, 1:50:31]: located we have talked with and have gotten agreement with them to use the space if we need to, but in trying to do things right we went beyond them to the property uh owners and and they again did not want to entertain taking it to public s until we're ready to lease the space. So [1:50:32, 1:50:33]: That's why we have what we have. [1:50:35, 1:50:36]: On that note, any additional questions? [1:50:36, 1:50:56]: Yes, the last question I'll have is if if we go to this additional step where they have to have a special events, all of that will be taken in consideration, correct? You will you will measure the parking spaces at the church, at the park to make sure that's sufficient even without publics. And I can kinda understand where you're trying to go. You don't want to commit long. [1:50:56, 1:51:09]: long term to that public park public parking lot because that that is a cash cost. They're not doing it for nothing and if you sign a term you gotta go. So if we're contingent upon um [1:51:09, 1:51:29]: uh, you know, you showing the profit or the business being successful. Um, you know, tell us how that that uh that that would seem to work perfectly, which Mr. Bond suggested, is that when they go to these events, if they go they came to us with an event that was greater than the um the capacity of the park and the church then [1:51:29, 1:51:31]: we'd have veto power over that, correct? [1:51:33, 1:51:49]: Yes, that's exactly correct. That's why we do these special events. We make sure that all the numbers work and that we we look at all uh the issues that may come up with it and we try to address those with a permit prior to. So and if it doesn't meet those requirements then we would say you cannot have this event. So yes. [1:51:50, 1:51:50]: [6711.3, 6716.0]: All right, so on that note, if there are no more questions right now, then you open up for a public hearing. [1:51:56, 1:52:05]: And so what I understand here we got um four different uh variants uh uh requests for four different various changes variants changes here. [1:52:05, 1:52:24]: We are looking for uh to go to forty foot versus a fifty foot, okay. Uh so we'cause we can't move a big building, okay. We're looking to reduce the uh parking lot requirement, I believe it is, okay? And that does that that involves the potential turnaround area or not. That does that's just that's just uh that does involve that, okay. [1:52:25, 1:52:45]: Uh we want to eliminate uh some loading space requirement, I believe I wrote down. Again the loading space requirement would be for a hotel. You need to have a space specifically dedicated to that for the deliveries and whatnot that you would get in a hotel because again, bed and breakfast is not clearly defined in the ordinance and that's how we would be [1:52:45, 1:53:01]: uh reviewing the plans based upon that. So any other requirement to request f uh deals with a metal c uh metal building. I didn't get the size of this metal building but typically it's supposed to be seventy five feet from the water, but this one's only got twenty five feet and the staff recommends that's fine. I don't know what size of this building is. [1:53:01, 1:53:13]: The size of the building at at this time is is irrelevant. The d it's it would be the distance from the building to the water's edge, which is twenty five feet. All right. So on those four different s variances requests, okay now. [1:53:13, 1:53:21]: For anybody on the open of public hearing here, so anybody from my left here that's in favor of this or wants to speak in favor of this [1:53:21, 1:53:23]: I need you to come forward on the left side. [1:53:24, 1:53:25]: Get anybody in the middle. [1:53:26, 1:53:27]: Yeah, Partyum. [1:53:27, 1:53:30]: You didn't include the um [1:53:31, 1:53:32]: Special events. [1:53:32, 1:53:33]: requirement. [1:53:34, 1:53:50]: Is that it m my recommendation would be that would be a condition of z of the variance approval if you move forward when you did a motion. Right now at the public hearing, it's not one of the items that is being discussed. Thank you. Okay. [1:53:50, 1:53:56]: Okay. Anybody opposed to these four different variances, uh far left. Anybody wants to speak on that? [1:54:00, 1:54:12]: Wha wa hold on a second. Are you speaking what for for or against now? I I I'm asking for the four variances speaking a against. Do you he make a comment against those those four variances that are being requested? [1:54:15, 1:54:19]: Okay, w hold on, don't don't talk from up don't talk from up there. You gotta come up here, please. [1:54:23, 1:54:24]: State your name. [1:54:24, 1:54:25]: An address. [1:54:28, 1:54:35]: I'm Diane Ide, I live at one eleven Prestwick Way South in Stockbridge and I'm just confused that everything I see says [1:54:35, 1:54:41]: bed and breakfast, but the uses for bed and breakfast and this is the first time understanding that it's an event facility. [1:54:42, 1:54:45]: Do first of all, is there parking adequate for the bed and breakfast? [1:54:46, 1:54:50]: And obviously there's definitely not enough parking for an event facility. [1:54:50, 1:54:55]: So the neighbors who live in that area may have a lot of of cause for alarm. [1:54:55, 1:54:58]: That there's a hundred people trekking across the property. [1:54:58, 1:55:00]: To get to this event facility. [1:55:01, 1:55:03]: I I'm just confused how to do it. [1:55:03, 1:55:08]: First of all it got denied by the county and we're talking about it and then, you know, how it is that [1:55:09, 1:55:14]: It's gone from a bed and breakfast, which is what everything indicates, to an event facility. [1:55:15, 1:55:24]: Okay. It's uh so it's a guess it'll be a bed and breakfast and also and also the question would be how long is the leaf on you how long is your lease? [1:55:25, 1:55:27]: What is the term of the lease? [1:55:30, 1:55:30]: All right. [1:55:34, 1:55:36]: It's still hope for public hearing. One second. [1:55:37, 1:55:38]: [6939.8, 6951.5]: Now in a public hearing, those questions okay, we keep going. That's what that's what I thought. That's why I just want to double check. Okay, anybody else from the left side here that has any comments uh against the particular [1:55:51, 1:55:54]: for Berry's request from the left side. [1:55:54, 1:55:55]: And in the middle. [1:55:56, 1:55:57]: On the right side. [1:55:58, 1:56:01]: Okay, on that note there are no other comments at the public hearing [1:56:01, 1:56:02]: is ended. [1:56:03, 1:56:04]: Okay. Now. [1:56:05, 1:56:08]: Back to the council. Any other additional questions from the council? [1:56:09, 1:56:09]: Uh. [1:56:10, 1:56:24]: I had one other um to respond to that question. That's why I um relied on the attorney when I was saying for is the lease, you know, for its owner, have we spoken to the you know, have the information from the owners and all of that? [1:56:26, 1:56:39]: We haven't seen the leases for the parking spaces for with the church or with the county. Um so I we just can't answer that question at this point. We haven't heard anything from the [1:56:40, 1:56:48]: Ho the owner of the property. Owner of the property is the actual applicant for this. Okay. [1:56:48, 1:56:48]: So [1:56:48, 1:56:51]: Speaking on behalf of the year. [1:56:53, 1:56:53]: Okay. [1:56:54, 1:57:14]: Yeah, but pretty much if I mean if it's not successful you're gonna go out of business, so it's not gonna be like, okay, well this it's it's i it's it's whether she makes it or not. We want her to be successful and we d uh to me we have controls in place that every event is being [1:57:14, 1:57:15]: Yeah. [1:57:15, 1:57:32]: Now we've already talked about the fact that you have uh a wedding facility in Morrill. That's your primary business, correct? I mean that is what you contingent of that you plan on continuing operation of that business. Yes. This the opportunity here [1:57:32, 1:57:52]: provides unique space for an outdoor venue uh that you cannot offer at your current location, which is the only r which is one of the reasons that you decided to bring your business to Stockbridge. Otherwise you could have just stayed in Morrow where most of the weddings uh will currently be. Those weddings will be there. [1:57:52, 1:58:12]: And then you will offer probably most of the times I guess maybe in the summertime or what have you. I think Mr. Blount made a very uh reasonable request in that uh we approve each event as they come along. I mean and you gotta think about this too. I mean, we do uh have to be business friends. [1:58:12, 1:58:32]: And that uh we have someone that's bringing a unique business. This is a unique set of circumstances because it is a bed and breakfast. It's very unique business. It is a tourist attraction that we will be able to bring to the city that we don't have now, that someone will be able to uh come to us to uh have some [1:58:32, 1:58:48]: uh accommodations that uh that we currently don't offer as a city. I mean I can vision this in looking at the lake and looking at the publics and see uh where you're trying to go. I think the the council really just wants to hear a consensus that [1:58:49, 1:59:09]: uh you know the direction that you're trying to go in is that you're okay with the limiting on the uh events and that the city would have a yeah nay but dependent upon because we don't want to do anything that uh would upset the neighborhood. I think uh Mr. Hall did a very good job of explaining to us that there's not gonna be [1:59:09, 1:59:29]: uh very many changes to the dynamic that we see and your attempt is to keep it uh as residential uh as possible which is not to disturb uh the neighbors. I guess Mr. Hall you bid answer to us the people living uh on the property w uh the surrounding property, what is the closest property to [1:59:28, 1:59:36]: to uh the ones uh that we're being asked to rezone. How close is the additional neighbors surrounding this property? [1:59:37, 1:59:41]: I I'll move back to the air photo to show that, but I will say that right here [1:59:42, 2:00:01]: This dotted line or this line that comes right here is the driveway to the surrounding properties. So this big yellow arrow is forty shows forty foot from the center of that driveway to the corner of that building. Now going to the air photo, which will show a little bit more information here. [2:00:04, 2:00:05]: Uh we'll go to this one. [2:00:07, 2:00:09]: This one here shows [2:00:11, 2:00:15]: This is the existing building right there, the existing house. [2:00:16, 2:00:29]: This is forty feet, right about the width of that hand is about forty feet. The closest house would be this one right here. That was part of the original development agreement. And I would have to guess if this is forty feet, that would be two hundred. [2:00:29, 2:00:33]: feet, and then the other house is back in this corner over here. [2:00:33, 2:00:43]: Right. So there are houses across the street and around the area and down Collier Drive, but again approximately two hundred feet from this would be the closest residence. And that's an estimate. [2:00:44, 2:00:44]: [7244.7, 7248.7]: Oh may I approach that. Yeah, just real quick. Um [2:00:49, 2:01:03]: Because w what are we looking for with this w with this item? What what are you looking for for us this time? If it it would be a variance request with f with four four different variance requests. You can approve [2:01:04, 2:01:10]: All of them, you can approve neither of them, you could come up and put your own variances on there. [2:01:10, 2:01:30]: Uh the request tonight is to have these four brought together with the fifth one I think that was described which would be that the special events get a special or you know and I think the verbiage was already written down um any special event would need a special event permit approved by the city and that would address my concerns with number two. [2:01:30, 2:01:32]: Which was the the parking spaces. [2:01:32, 2:01:47]: Because the parking spaces there would be, in my opinion, adequate for the bed and breakfast. This is not an event facility and my concern was if it went to that we wouldn't have the parking. So having this event permits, the parking would be elsewhere and it would not be an event facility. [2:01:48, 2:01:55]: Yeah, your recommendation was without any other entities for us parking, is that they build a roundabout in there? [2:01:55, 2:01:59]: Because what what what you're saying is that you're coming if you have an event there [2:02:00, 2:02:16]: Whether it's whether you do get parking anywhere. You're talking pulling in out on the street and just and and and bringing people in, what you're saying, right? But the applicant is saying is that parking will be off site and there will be very rarely You're missing what I'm saying, Mr. Hall. [2:02:16, 2:02:18]: I'm saying even off site. [2:02:18, 2:02:30]: When you shutter them in, it's in, back out, or back in, but it's it's not a turnabout turnaround in there. There is not a turnaround in there. Is there room for a turnaround? Yes. [2:02:31, 2:02:35]: There is room to create one if it was [2:02:36, 2:02:41]: If it was uh right now it would be required to have something to turn around. [2:02:42, 2:02:45]: She's asking for a variance on that, which would be [2:02:48, 2:02:56]: Eliminate the loading space requirement and number two, that would eliminate the need for a turnaround. I think we need something on that property to turn around if you're gonna have events there. [2:02:57, 2:03:05]: If you're gonna have events on that property, then you need a turnaround on that property. You're gonna have uh deliveries on that property, I think you need a turnaround. [2:03:06, 2:03:08]: Can I address that? Yes, you can. Go ahead. Okay. [2:03:08, 2:03:26]: We're not gonna have deliveries. Uh the whole thing is we're not trying to be a best western hotel. We're we're going to remain a bed and breakfast. So we're not having huge deliveries coming in. Um what we're going to be buying is that that you would buy for your home. [2:03:26, 2:03:40]: in that volume. So no additional space we feel is necessary for loading outside of parking. A quick question. Then if you're having a a wedding on that property, how would you get the chairs there? How would you get the tables there? They're stored on property. [2:03:41, 2:04:01]: The tables and chairs are stored on property. We have some in the building, the detached building that he mentioned, and on the outside of it is kind of a storage area. We're only talking about for weddings being able to handle a maximum of 150 people. We have storage area on [2:04:01, 2:04:21]: site that will maintain the tables and the chairs. The people that will be attending the event again will we will not drive on to the property to drop those people off. We'll be driving over to the church, that parking lot directly across the street from the property to drop these people. And they will walk [2:04:21, 2:04:24]: haven't fixed anything there. Is that the one where you said the path is? [2:04:25, 2:04:32]: Right, it's it's next to where the path is. But what happens if it rains and they don't you if you don't facilitate a path [2:04:32, 2:04:43]: And you don't have the park. I'm just saying the whole direction of this for me, I'm just speaking for me. Right. The whole direction for me of this project has gone toward events rather than [2:04:43, 2:04:57]: I'm looking at bed and breakfast. We got the parking space for bed and breakfast. It's a beautiful area. They you know let's move on. But now it's like we got all these special barrences. We got different elements and different components now. [2:04:57, 2:05:02]: And I'm not comfortable mak I'm again I'm not comfortable making this decision. [2:05:03, 2:05:04]: For me. [2:05:04, 2:05:10]: Because of the shift in direction because you uh worked thirteen years in events [2:05:11, 2:05:31]: I thought we was getting somebody that has run actually ran a bed and breakfast. Running a bed and breakfast is is a little different from running a hotel. It is. I've dealt dealt with bed and breakfast and it's different from running a hotel. Oh yeah. There's some differences, I agree. But let me also address what you said in case of rain. In case of rain that's why we're also maintaining the property in Morrow. [2:05:30, 2:05:50]: In case of rain and that's why we also handling the transportation piece for the clients because in case of rain, most times you won't know that until the day of uh we don't want people coming to the property in case of rain. The wedding will then be moved to our property in morrow and held inside. [2:05:50, 2:06:10]: say rain I'm not talking about that day. I'm talking soft soil. Soft soil if conditions are are not sufficient enough to safely bring people on property, we will move the ceremony to our property and morrow. That's why we're we're handling the transportation piece because we're gonna have our clients [2:06:10, 2:06:30]: give one address for the wedding and the reception. One address. And that will be the address of our Morrow facility. So they will meet there and we will either bust them to Stockbridge for the ceremony or we will leave them at that Morrow property if weather does not permit having an outdoor [2:06:30, 2:06:34]: event and conduct everything on site there. [2:06:35, 2:06:54]: If if I may clarify something, the driveway that is shown right here is a concrete driveway that exists. It is configured to handle if you had a passenger van, a moving van, something like that. It's configured to allow for the vehicle to come in. [2:06:55, 2:07:15]: Drop off, maybe back back out into this little eyebrow area and pull out. The driveway as it's configured, in my professional opinion, is not set up or configured to handle a bus, a large it it just will not. You would have to back it in or back it out onto the main road here. That's why you would [2:07:15, 2:07:27]: need some type of turnaround area so the bat so the bus or a large vehicle moving uh you know eighteen wheelers something like that couldn't get in and out of the site without having to obstruct this road. [2:07:28, 2:07:30]: Limousine might have a difficult time. [2:07:32, 2:07:34]: I mean every women I've seen here limousine. [2:07:36, 2:07:56]: So that's why I brought it to the attention that maybe there should be some type of turnaround. But if there is something that is proposed for this, again I would recommend having something that might be impervious design. It wouldn't be you know yeah, something impervious in design to allow in a turnaround area, an eyebrow here, something to allow for uh better [2:07:56, 2:07:57]: better turnaround for a larger vehicle. [2:07:58, 2:07:59]: So go right ahead. [2:08:00, 2:08:20]: Yeah, what I was going to ask is if um if with with all the questions, what we may want to do is if the council is amenable, tabling this item and have more further conversations with Ms. Johnson and see if we can come up with something that be amenable on both sides and bring it back for another future meeting date specific. [2:08:20, 2:08:28]: I but just let's do this. I mean is the council ready to vote on on all four of these variances or a combination of four variances along with the special event? I'm not. [2:08:28, 2:08:48]: I know you're not. Are you v are you? Uh uh with the condition that they would be able to we can talk about the van, we can talk about um the conditions um that we place some of the special uh a permits. I we gotta start being a little bit more friendly to these businesses when they come approach us. They do. Are you ready to [2:08:48, 2:08:51]: Vote on the uh the all four conditions or special event permit? [2:08:52, 2:09:00]: Mayor Protein. What one second, I'm my I'm asking a question here. I mean I'm just bold right here. [2:09:02, 2:09:11]: Okay. [2:09:11, 2:09:21]: So you o ask her if she's okay if she's okay with the turnover. Well let's ask her right now. She might you know to make this happen tonight, she might be okay with it. So when they ask you. [2:09:21, 2:09:30]: Okay. Ms. Johnson, um my concern is the the main road and the turnaround. If that's something that we can clear tonight, I can vote with you. But [2:09:31, 2:09:33]: Without that I still need to [2:09:33, 2:09:35]: See what we need to do on that. [2:09:38, 2:09:40]: Okay. Um [2:09:41, 2:09:51]: My only reservation with doing a turnaround is again we're only talking about doing a turnaround to accommodate a bus. [2:09:52, 2:10:12]: I think the driveway is sufficient for a limo to turn around, van to turn around, any other vehicle. So we're only talking about a bus. And the bus is only going to be in the equation hopefully for a year or so until we prove profitable and can lease a space at Publix. [2:10:12, 2:10:13]: [7813.6, 7828.0]: I just hate to make that type of investment, not only that, but disturb the landscaping and the current ambience of the facility to create that for a temporary period. [2:10:29, 2:10:34]: Also let me mention too, I don't want to offend, but I do want to [2:10:35, 2:10:42]: just open your eyes to similar situation. Similar situation is the [2:10:42, 2:10:44]: Food trucks on Tuesday nights. [2:10:47, 2:10:55]: They park across the street, your guests currently use the field and park across the street and your activities happen over here on the lawn. [2:10:56, 2:11:02]: You have families, the same type of families that will be attending weddings perhaps. [2:11:03, 2:11:12]: you have no cross walks, you have people that are crossing the street and this street is much busier than Old Conyers Road. [2:11:13, 2:11:33]: There's no assistance currently provided to folks to help them cross the street, no cross guards, no officers assisting with them crossing. They're left on their own. What we want to do is add another measure to that. The same thing. Park across the street, have people. [2:11:33, 2:11:53]: People cross the street but add some assistance. Assistance will be cross guard or police officer or security, something of that nature that can help people get across the street. Also to be able to uh provide a small shuttle van or something that can assist those people from the parking lot. [2:11:53, 2:12:01]: to the property for those who just can't walk across the street, your elderly or what have you. Ms. Johnson. Yes. One second please, sir. [2:12:01, 2:12:03]: Um [2:12:03, 2:12:12]: The police officers are s are stand are there so I believe they I've seen'em assist people back and forth. But but uh in a sense uh the for our conscience as well. [2:12:12, 2:12:18]: I need to say that. Yes, sir. Go right here, please. Ms. Johnson, when it comes to the food trucks, it's not a good analogy because [2:12:19, 2:12:21]: We own that property across the street. [2:12:21, 2:12:22]: Mm-hmm. [2:12:22, 2:12:25]: And we have control with police officers on the traffic. [2:12:26, 2:12:28]: And where the food tricks part, there is a turnaround. [2:12:29, 2:12:35]: So we we have to be cautious on what analogies we use. On your property it's uh bed and breakfast. [2:12:36, 2:12:38]: That's gonna host events. [2:12:39, 2:12:43]: that right now you don't own anything to facilitate those events. [2:12:45, 2:12:50]: The parking. [2:12:50, 2:13:10]: Right, but so would the written agreement would not suffice? You haven't shown us anything tonight in writing that you're so sorry that I don't have that. So we're talking solely apples and oranges right now with the parking lot. Can we do a condition provided that you see that agreement? I would like to go off with recommendations off of our city manager saying to table this discussion [2:13:10, 2:13:14]: right now because if I vote right now mine would be no. [2:13:14, 2:13:22]: And if there's anything that we can discuss that would say, Hey, we meet we met on common grounds, I would not want to come against you prospering in this city. [2:13:22, 2:13:33]: You you see what I'm saying? So what you're comfortable with I'm hearing then is the turnaround. If we add a turnaround to the property I'm not just saying that there are elements put in this that are conducive to events centers. [2:13:34, 2:13:54]: We have an event center. And so we have to look at these different components and come to an agreement'cause we can talk all night on this, but until we sit down and look at now these new elements put in place, we're all we're gonna do is continue to discuss. So I would say once again that we would do off the recommendation of uh uh city manager and just table this or we can now discuss this among [2:13:54, 2:14:14]: among ourselves we we communicate, believe it or not, o outside of the city council and look at these different elements and then we could say, Hey, this is what we'll we' we we'll settle for, this is what we'll do. We can get a consensus on things without being in the in the chambers. So I would ask you that I would bleed up would be the route for us to take tonight on this. But we'll just [2:14:14, 2:14:34]: The only thing I would like to say is this are you conducive to having the turnaround now since you see that this council is resistant to that? If the turnaround will solve the situation, yes. I I am. So you're you're okay with doing the turnaround? [2:14:34, 2:14:54]: on the property. Uh you're okay with us having a special events uh approval or process to be introduced in the city uh for these events so we will get to uh say yay or nay to these properties or to these um events as they come forward. I think Ms. Robinson's concern was [2:14:54, 2:14:55]: was the driveway, is that correct? [2:14:56, 2:14:57]: Okay. [2:14:58, 2:15:01]: Right. Are you okay with doing the driveway, the turnaround? [2:15:02, 2:15:11]: I'm okay with doing the the turnaround. Um the special event I'm I'm okay well, I thought the turnaround was [2:15:13, 2:15:33]: instead of the special event or the special event permit well. We want to do both of them. You want to do the tournament special events. Are you okay with that? I'm okay with doing both but I ask that for the special event if we can state a time period I mean if we can state at least until we lease the space at Cro [2:15:33, 2:15:53]: There's a fee involved and a lot of red tape involved with the special event. Perhaps I don't understand all of the requirements. But what I'm asking is five years down the road when we already have this uh facility at Stockbridge where we continue to have to be held by [2:15:53, 2:15:56]: this condition to get a special event permit. [2:15:56, 2:16:16]: I think where we are right now is this is the offer. Okay. And if you're not contingent upon that, then pretty much we need to table it and we need to move on. Well besides wait a minute, just a second, sir. Besides that, if you say you're agreeable to a turnaround, the what kind of turnaround we're talking about? See we haven't talked about those specific things. [2:16:16, 2:16:36]: You know, you're talking about some of the the path from publics to the to to the facility of Prosper Lake. I thought it was a concrete path. You said no, it's kind of mulch. So the turnaround we need if you even agree to a turnaround, what type of turnaround? And if and and it has to be something more sturdy to allow for those those vehicles to turn around. I would imagine more permanent which means concrete to me. [2:16:36, 2:16:54]: You see what I mean? In that aspect. So we may have to go back to to talk about his particular recommendation that Mr. Councilman Blount is talking about, but before you say, Sir, go right ahead, you have something else in your mind? [2:16:55, 2:17:05]: To the point, yeah, we there is you can't applicant can always come back and do a modification of a condition. So that's always uh an option. And and yeah, I think a lot of these can be fleshed out. [2:17:07, 2:17:27]: having the conversation on specifics of the of a turnaround, time frame for a turnaround and things like that. And we can come to a um a resolution that would be I think address all the council's concerns as well as um Ms. Jackson's concerns as well. So again I I stand the recommendation of allow staff and [2:17:27, 2:17:36]: council and have you know some more subsequent conversations to flesh out some of these details and come back with um one more time else you need to say. [2:17:49, 2:18:09]: All right, so I need a motion. I I guess in if we if we think about tableless, I still need to do a motion for the case. Can I can I say I am amenable to the special events and the turnaround that is being requested. I am good with those two things. But uh I got that. But uh but there are other things involved here. But anyway, so I need a motion, counsel, on what [2:18:09, 2:18:17]: w what direction you want to go. Whether it's uh the tableness, whether it's the septis, uh the verbage, the the turnaround and and the special events [2:18:18, 2:18:26]: I I'd like to make a motion that we um table this to s for further discussion and further clarity on what we need to do as a council. [2:18:26, 2:18:29]: Okay. [2:18:30, 2:18:33]: Councilman Blount, seconded by um Councilwoman [2:18:33, 2:18:34]: Robinson. [2:18:34, 2:18:37]: I'm gonna ask f I'm asking for a specific date. Yes, yes, sir. [2:18:38, 2:18:42]: Uh it would be helpful to designate a a date certain [2:18:42, 2:18:49]: Uh, for both for the public as well as for the applicant, so know when it's being tabled to. Okay. [2:18:49, 2:19:03]: Um all right, so that would have to be your mo motion would have to be amended. So let's see, this is a regular council meeting, so the next meeting uh we have actually is our next work session which is what the twenty seventh. September twenty seventh. September twenty seventh. [2:19:04, 2:19:10]: Yes. Okay. Are you ami uh you willing to uh amend your motion to [2:19:10, 2:19:13]: Have this discuss on September twenty seventh. [2:19:15, 2:19:16]: Yeah, we can amend it. [2:19:16, 2:19:22]: Put a discussion on I'd like to amend a motion to uh have a discussion on the next meeting which is September the twenty seventh. [2:19:24, 2:19:24]: Okay. [2:19:25, 2:19:27]: It doesn't need to have a re second then, does it? [2:19:28, 2:19:31]: Uh but he restated it, so let's get it a another second. [2:19:32, 2:19:33]: There we go. [2:19:33, 2:19:33]: [8375.1, 8375.6]: All right. [2:19:36, 2:19:37]: On that note, any further discussion. [2:19:38, 2:19:41]: All in favour of the motion, please indicate. [2:19:41, 2:19:47]: All right. There you go. Okay. So, to all that discussion, we'll do this again on the twenty seventh of September. [2:19:49, 2:19:49]: All right. [2:19:51, 2:20:08]: The uh yes. We've got to take a look at it. Right. The next item, uh item number eight actually deal thank you, Ms. Johnson. We'll we'll see you in a couple of weeks. All right. Um item number nine, excuse me, and item number eight deals with the Highway one hundred and thirty overlay discussion. Mr. Hall, please. [2:20:08, 2:20:09]: I am back again. [2:20:11, 2:20:15]: Luckily this is my last item of the evening, so that should make everyone happy. [2:20:16, 2:20:17]: Um [2:20:19, 2:20:20]: I am [2:20:20, 2:20:24]: Uh give me one moment as I pull up a map for us to discuss from. [2:20:34, 2:20:35]: Okay. [2:20:46, 2:20:47]: Okay. [2:20:47, 2:20:52]: Staff was requested uh there was a quest to staff to uh [2:20:52, 2:20:53]: Look at [2:20:53, 2:20:57]: the creation of an overlay for Georgia High one hundred thirty eight. [2:20:58, 2:21:01]: And staff had contacted several companies [2:21:01, 2:21:02]: Uh to [2:21:02, 2:21:09]: come up with a uh we s we we put together uh an RFP and contacted some companies to give a [2:21:09, 2:21:13]: uh presentation or proposal on developing this overlay. [2:21:13, 2:21:14]: The plan is [2:21:15, 2:21:33]: intended to be in similar scope to the existing Clayton County 138 overlay and would focus on setting a higher level of design and aesthetic standards for future development in the area. The end product wo or may include design guidelines and a zoning code which would be used to implement the guidelines. [2:21:33, 2:21:42]: Please note that this is not a budgeted project and therefore the proposals did not have a specific time date. They were basically set for how many months they could be completed. [2:21:43, 2:21:53]: Well the map that I'm showing you right now would show shows the area in red here, which is on North Henry, and one thirty eight where it splits, right here is the Walmart. It would include this area. [2:21:54, 2:21:59]: This part of one hundred thirty eight is actually in Henry County. [2:21:59, 2:22:01]: And then Clayton County. [2:22:01, 2:22:04]: And then City Stockbridge. [2:22:04, 2:22:11]: then Henry County, then Clayton County. So it would only include the area that is in Dash area. [2:22:12, 2:22:32]: Now keep in mind that the staff is working on um putting together a an RFP for our comprehensive land use plan, which would include items and considerations of overlay. It is due by the states by uh the due date is in twenty eighteen. [2:22:32, 2:22:52]: And this would typically an overlay such as this would typically be a component of the comprehensive land use plan. So my recommendation of staff is to do this as a comprehensive land use plan, make this a component of it, and I believe that you would get a much better [2:22:52, 2:23:12]: better return on the investment of that because this overlay on its own for these two smaller areas is is a large uh sum i uh f to to complete. If you put it as part of a larger project, then I believe it could be rolled into that for a much better cost and come for [2:23:12, 2:23:32]: At the same amount of time. There are about 30 to 50 properties that would be part of, and that's an estimate. I did a brief count on them. That would be included in the overlay as it sits. And the majority of those properties are already built out. So when you take that into consideration, there's a smaller [2:23:31, 2:23:51]: Amount of properties left to be developed. So the overlay is intended for when those properties would be redeveloped or when there would be rezonings on properties. We did have a rezoning uh some shortly on this little triangle piece right here that was the hotel and restaurant. [2:23:52, 2:24:06]: It was either this year or early last year, and we were able to utilize the Clayton County overlay and put a myriad of conditions on it that basically would have been part of our overlay, would it have been in place at that time. [2:24:07, 2:24:18]: I'd be more than happy to answer any questions you may have about this. Again, my staff's recommendation is to make this part of the comprehensive land use plan that we're going to be working on uh shortly. [2:24:18, 2:24:19]: That's not go ahead, sir. [2:24:20, 2:24:21]: [8662.8, 8676.1]: Ladies and gentlemen, um this is something that I think that we as a council have have have promised the citizens that we were gonna do, that we were gonna raise the standards and clean up North Henry Boulevard and Highway one hundred thirty eight. [2:24:37, 2:24:53]: This uh component goes a long way in that direction of doing that, establishing what type of businesses are allowed, um, the zonings, the requirements, uh, even uh multi use path requirement uh along this uh corridor. [2:24:54, 2:24:55]: Oh. [2:24:55, 2:25:00]: I disagree with the staff recommendation that this needs to be a part of the comprehensive plan. [2:25:00, 2:25:10]: Because with all due respect we've been waiting on the comprehensive plan for far too long. This needs to be segmented out because Highway one hundred thirty eight is at a critical mass. [2:25:12, 2:25:21]: Any longer, any wait any time longer, uh there's another Dollar General, okay, there's another pawn shop, there's another tire shop, I mean there's another tire shop. [2:25:22, 2:25:42]: The date for that to happen is tomorrow if we don't do anything about it. And we waited far too long to raise these standards. This section on Highway 138 needs to be pulled out and we need to move forward. That is ground zero for infiltration of the type of things that we not want to see in this community. [2:25:42, 2:25:50]: and we're losing the battle right now. This helps us to to to hold the line where it is and to turn it around. [2:25:50, 2:26:10]: Because when the tire shop shuts down, uh the development standards probably won't allow for another one to open up. When the pawn shop shuts down, it'll require a better development to be established in that particular area. And will also require aesthetics uh standards uh to be built in in that area. [2:26:10, 2:26:11]: This particular area. [2:26:12, 2:26:25]: Meaning you just can't come in and throw up uh any kind of building that you want. You have to have strict standards that allowed uh for the this particular area. Um this is critical mass to me. [2:26:26, 2:26:32]: I I think that, you know, when we talked earlier this year about the parcel could you point out that parcel one more time, Mr. Hall? [2:26:36, 2:26:56]: Right where their hand is. Right where the hand is. We have absolutely no standards established for that. We made up the standards on the fly and they agreed to uh adhere to those standards. Today, if something else wanted to come there, we'd have to walk back through that entire process once again. Today I'm calling on counsel. [2:26:56, 2:27:14]: Council to move forward with establishing new standards, as all of us said, that we wanted a new start bridge. This is a new era, this is a new time. This is where you started right here. You start by laying down the foundation to decide what you allow in your community today. [2:27:15, 2:27:35]: And that's what we want to do uh in order to make this happen. I'd like to know to get feedback from the the rest of the council because I know we sat here uh for at least you know almost an hour debating about the hotel, what it was supposed to look like, uh what we're s what is supposed to be contributed to that. With these design standards and guidelines. [2:27:35, 2:27:35]: Yeah. [2:27:36, 2:27:41]: We you can't just bring any project to this overlay zone. [2:27:41, 2:28:01]: All of the things that we want stockbridge to look like and how and and the definition of all those would be in this overlay. If we wait on a comprehensive plan we could be waiting for another year. We could be doing another two years. Why? Or we won't we want to do that when we can go ahead and move forward with this. Uh I think Clayton County has [2:28:01, 2:28:02]: Yeah. [2:28:03, 2:28:19]: Uh they've already s set their standards on their side of this border with what's going on. If you look in front of uh the Golden Corral uh restaurant that's on uh that stretch of Highway one thirty eight, they have a eight foot multi use path already in front of it. [2:28:19, 2:28:39]: that was new development that was established in the area, their code required that a eight foot path be put in front of it. But some someone today could come and open up a new business along Highway thirty eight one thirty eight on our side, they wouldn't have to do that because there aren't any requirements as far as ours concerned in terms of [2:28:39, 2:28:59]: of making the area improvements. Clayton County is also working on a community improvement district, a CID, in order to strengthen this area and have private contractors maintain the grass, maintain the media, and maybe even add security like they do over at Camp Creek market. [2:28:59, 2:29:05]: place. They have a C I D over there that encompasses all of the above and includes a security force. [2:29:06, 2:29:26]: uh in addition to supplement uh the police department paid for by the businesses, not by the city uh themselves. We have seen that we are a little we are behind. They've already have their CID standards in place. They already have their um uh overlay in place. We gotta start making steps [2:29:26, 2:29:36]: And I don't think at this point we can afford to wait much longer. We drive down North Hemory Boulevard every day. It's unacceptable. [2:29:37, 2:29:45]: All right. Any other thank you. Any other council comments on this this issue? This roof, sir. Uh Mr Hall, you said that the comprehensive land use plan would [2:29:46, 2:29:48]: be completed in twenty eighteen? [2:29:49, 2:30:09]: The State requires that we have the next version of our comprehensive land use plan completed by October of twenty eighteen. So we're in the process of now deciding whether we're going to work with the DCA to write our comprehensive plan or whether we're going to put it out to bid as an RFP for another firm. [2:30:09, 2:30:20]: firm to do the uh the project for us and uh the overlay would be part of that. Are these RFPs are these proposed uh companies here that we have the four here? [2:30:20, 2:30:40]: The the companies that are listed in here have no uh relationship to the comprehensive land use plan. What's put in this is just for the overlay. Yeah, that's what I'm saying. I am speaking specifically on the overlay, not the comprehensive land use plan. I have received RFPs pro I I have received proposals from each of these firms. [2:30:40, 2:30:51]: in this amount with these timelines to deal with specifically this overlay. So right now if we wanted to do specifically the overlay, I'm not talking about the comprehensive land use plan. [2:30:51, 2:30:53]: that we can get it done as little as four months. [2:30:54, 2:31:14]: It could be done in four months. First of all, we have to find where we're getting the finances from because this is not something that is uh in in the budget. It's not been budgeted in two thousand sixteen. It's not even that's a different topic. I'm just talking speak speaking specifically on what could be done if the money was there. I'm just looking at what you have. Staff looks at that entirely also to see if we can prep [2:31:13, 2:31:20]: So we'd have to put the finances together and then have the city council approve it and then it would take four months [2:31:20, 2:31:26]: Or or more depending on who we decide to go with to put this in place. But I'm looking at what you have here. [2:31:26, 2:31:30]: You w dealing with these companies here specifically for overlay. [2:31:30, 2:31:39]: Correct. You got one that says you got one that says four months, one that goes for one six months. Correct. And the amounts. Correct. So if we did the overlay [2:31:40, 2:31:44]: I'm not talking about talking to Miss Neighbors, I'm talking about what you have here in front of us. Mm-hmm. [2:31:44, 2:31:48]: it could be done if this was feasible within four months. [2:31:48, 2:32:04]: Yes. Okay. And it would encompass the areas in red right here. There was some discussion about North Henry Boulevard and discussion about uses. It's important to understand that uh overlay does not deal with uses. [2:32:05, 2:32:13]: Okay, that's a zoning map that's entirely different. That's changing the comprehensive land use future land use map. [2:32:13, 2:32:21]: And that's why I said it's important to look at the whole picture, work on the whole picture instead of pulling out a piece of the [2:32:22, 2:32:23]: Puzzle. [2:32:23, 2:32:29]: and working on that. Because we're going to back up and do this again when we do the comprehensive land use plan. [2:32:29, 2:32:32]: The reason I'm asking is because [2:32:33, 2:32:36]: People are finding out that y that the city of Stopbury is in a unique [2:32:37, 2:32:38]: [9158.8, 9160.0]: right off the interstate. [2:32:40, 2:32:44]: We're in a unique area. So now we because we've had a lot of discussions about [2:32:44, 2:32:58]: how this is gonna look, how that's gonna look. They have to come back and we discuss again how this gonna so that component is important because it touched it cuts down a lot of time. It absolutely is important. If you look at time and m time, time is money when you look at [2:32:58, 2:33:00]: what you have to produce and what you have to do. So [2:33:01, 2:33:05]: Are we cutting down a lot of time by getting the overlay done in four months? [2:33:05, 2:33:10]: versus waiting on the comprehensive plan because all it whatever happens gonna cost money. [2:33:11, 2:33:20]: Either we equ either money gonna gonna be a cost because of time or money gonna be a cost because of implementation uh putting money in place to do something. So either way you look it's it's [2:33:20, 2:33:28]: It's it's time, it's efforts. We got a staff sitting here right now, I'm pretty sure they would rather be home right now. So everything is has a cost to it. [2:33:29, 2:33:41]: You know, I mean with all due respect. You you you see what I'm saying? So I'm not talking about it. I understand exactly what you're saying. My point is that an overlay is a major component of the comprehensive plan. [2:33:41, 2:33:49]: w it's putting the cart for the horse. Now we might uh the council believes that this is an important item that needs to be done as soon as possible. I understand that and I respect that. [2:33:49, 2:33:51]: But we're going to have to re look at it [2:33:51, 2:33:53]: again anyway. [2:33:53, 2:33:56]: We're going to write it, do it, and then re look at it again, write it and do it again. [2:33:57, 2:34:11]: Back to back. So part of the comprehensive land use plan is to look at all of the overlays, look at all of the zoning, look at comprehensively how the cities set their goals and objectives and how they want to grow in the next twenty years. [2:34:12, 2:34:21]: Where is that going to go? This is one tiny component of how we're going to grow in twenty years. So I'm not against it. This is a very valuable thing that needs to be done. [2:34:21, 2:34:27]: I'm just trying to again give my professional opinion of how it should be done to make it most efficient [2:34:28, 2:34:48]: for first of all the finances and what the citizens are going to look at. We're going to have to have public hearings, we're going to have to look at what the city council was, we're going to have to do this. It's a very comprehensive approach for this overlap. But then we're going to have to do it again. So I just want to make sure you're aware of this, that we're going to revisit it next year. We're going to go forward. The comprehensive plan it on on one hundred thirty eight. Is that [2:34:48, 2:34:58]: d because you're dealing with uh Henry County and Clayton. No, when I say comprehensive plan, it's the overall design goals for the whole city for the next twenty years. [2:34:59, 2:35:08]: But what I'm asking is with the comprehensive plan that you were talking about, what we have to also if we're gonna look at that area, what we have to do in the intergovernment agreements [2:35:08, 2:35:28]: with those with the county, Clayton County and in uh Henry County. It's not an intergovernmental agreement. What it is is since it's comprehensive, we would be involving them in our process to get their input on how we would design that area for the next twenty years. We also do that for Henry County's plan. We also do that for Clayton County's plan. We get input [2:35:28, 2:35:36]: Clayton County is on a different schedule than we are, but all of Henry County is required to have it done by 2018. [2:35:36, 2:35:48]: So that means uh Hampton, Locust Grove, you know, all the other cities. Um go ahead. Okay. That's a good have a go ahead and so [2:35:48, 2:36:07]: I I understand what you are saying, but I disagree in that I understand just like you do how these comprehensive plans work. Two thousand and eighteen is when the plan's gonna be ready. That don't mean you're gonna do anything. It just means the plan has to be ready and submitted. There's no timetable to [2:36:07, 2:36:21]: uh you know, some of the projects, uh this project could be done in two thousand and twenty, this project could be done in two thousand and twenty two or whatever the case may be, as we label out what we're gonna do in the comprehensive plan. [2:36:22, 2:36:26]: those projects could be laid out over time. Whereas we could do this right now. [2:36:27, 2:36:31]: We could do this in four months, put the first piece of the puzzle in place. [2:36:31, 2:36:33]: Yes, we will have to [2:36:33, 2:36:40]: As you said, we'll have to look at all the areas in the entire city. Yes we would. But at some point [2:36:40, 2:36:43]: We need to work on the areas that are most critical. [2:36:43, 2:36:47]: That's why I'm pointing to Highway one hundred thirty eight right now because it's critical. [2:36:48, 2:36:57]: Eagles Landing, not quite Eagles Landing, you know. We don't need to look at Eagles Landing like we look at Highway one thirty eight. Because if we do [2:36:58, 2:37:13]: we're gonna lose Highway one hundred eight. We don't have that time to wait that we do or or to uh compose the plan for the entire city on uh all of these areas.'Cause we can't work on all of'em at the same time anyway. But [2:37:13, 2:37:24]: We've been talking about this and before I got on this council I heard you get up at this podium and pro and we've been talking about these same issues here uh beforehand. [2:37:24, 2:37:38]: We haven't gotten anything done with all due respect. I want this timetable put on this so we can get something done. That's what I want. I'm wanting to get something done. We were supposed to have zoning code rewrites done when I was sitting out there. [2:37:38, 2:37:58]: I'm up here now. I don't mean to throw you all up under the bus, but I'm tired of waiting and I want to get back if I may say that that zoning code has been completed and and staff has been working hard on the items that have been brought up. I disagree. We've had some drone we've had some zoning uh we had some zoning updates. We went to a zoning advisor. [2:37:58, 2:38:18]: Board, but we have not went over all of these areas in the city. We still have that designation where the family dollar is in front of uh Red Oak. We have not changed those zoning, those where where a business a commercial business could go in front of that particular property. We were supposed to sit down and look at uh you know what we were gonna do. [2:38:18, 2:38:38]: do with all of these particular zoning areas in the city, designate them downtown as well. We still don't have those things in the place. Again, we got to look at downtown, we got to look at all areas of the city. I'm calling on us to move forward with the most critical time sensitive area in the city, which is [2:38:38, 2:38:42]: [9523.6, 9524.6]: Also they have the [2:38:45, 2:38:45]: [9526.4, 9535.9]: A way that we can um'cause I do better when I see the task hours and you know, the the fees, what's like phase one, what that consists of. [2:38:56, 2:38:57]: That's what the fee is going to be. [2:38:58, 2:39:04]: Um, can we request that with these other proposals?'Cause when I was looking at it um earlier this earlier this week [2:39:05, 2:39:06]: That was something [2:39:06, 2:39:08]: Um that would help me. [2:39:08, 2:39:23]: It's my understanding that and and I apologize if it's not set that way that they are actually were they included in the packets, the proposals? Yeah, the one the first one um that you have on here, it doesn't have like the second. [2:39:23, 2:39:25]: that I'm looking at. Design guidelines. [2:39:26, 2:39:29]: The first one does not. It's not set up that way. [2:39:30, 2:39:35]: And also back to when we were talking about I just want to touch on the one thirty eight, we also had a town hall [2:39:36, 2:39:45]: um earlier on to show the importance of one hundred thirty eight, where we're wanting to go with that. So um I I [2:39:47, 2:39:51]: I mean w we had Clayton County here, um at that town hall, so [2:39:52, 2:39:57]: I guess we just wanna try to see what we need to do, how we need to get there. Um, if it's, you know [2:39:58, 2:40:01]: feasible timing wise, if that's something we can do, um [2:40:02, 2:40:16]: I guess reaching out, having conversation or what, but I know we did have a town hall earlier on this week when we came um and we were talking about the one hundred thirty eight. We were talking about the C I D or this the area. [2:40:17, 2:40:20]: I guess I'm I'm confused at a couple things that have been [2:40:20, 2:40:21]: Brought up and [2:40:21, 2:40:26]: I'll reserve my comments to uh a later time and a later date. [2:40:26, 2:40:30]: But um as C I D again and we discussed this a C I D is not a [2:40:31, 2:40:39]: an issue that's brought forward by the city. This is something that's brought forward and and and spearheaded by the the [2:40:40, 2:40:46]: Right. The private sector. Right. And I understand that I was just saying that, but w is still pertaining to the one hundred thirty eight. [2:40:47, 2:41:07]: Because we were saying that was of importance and we wanted to make sure our focus is there. However we got there. We just know that was our main concern to work on that. You you see what I'm saying? Mayor if I if I could jump in. Yeah, go right. Yeah, and you're right. I mean there's been a number of a lot of conversation in regards specifically to one hundred thirty eight. Um [2:41:07, 2:41:27]: There's a couple points. And you're right. Mr. Hall's correct. We've had the C I D, you've had the we've had the town hall meetings on how the how a C I D functions and that is a a function of the private industry. They drive that and we certainly can we've um made it known that that's certainly our intent to assist with that process. Um [2:41:27, 2:41:30]: to jump back to Councilman Alexander if I may. [2:41:30, 2:41:37]: You're right, there have been a number of things that have been noted that have been discussed by this council and and former councils. [2:41:37, 2:41:38]: Um [2:41:40, 2:41:45]: But you have to understand that there is a sequence and a timing and a prioritization of things. [2:41:46, 2:41:47]: As stated. [2:41:49, 2:42:09]: This what was you know, we've had this conversation. The one one thirty eight overlay, we budgeted a certain amount of funds for professional services consulting, things of those nature. Those things we've exceeded that budget because we did some additional things. We did the annexation study, we did the zoning code study, we did the master trail plan, all those things came out of that. This wasn't a designated [2:42:09, 2:42:20]: item as was stated when the budget was passed last year. Now mind you, when the new council came on board, these are items that were absolutely that have been have been discussed. [2:42:20, 2:42:23]: And so what we've done at this point is put the proposals together [2:42:23, 2:42:36]: to show the council. But it's not a matter of saying we're just not going to do it because we're not going to do it. But and there's no funding associated with it. That's part of the conversation presumably tonight. Um that this is a desire of the council. And again [2:42:38, 2:42:43]: Our role here is to provide our professional opinions. That's you know [2:42:43, 2:43:03]: that's that's what we're here for, to let you know what we thy w we what we think is the the the uh uh uh a prudent manner of how to how to proceed. Um certainly and it is that can we go and take this step prior to going that step? Absolutely we can. And I think that's been stated tonight. The next step in that process would be [2:43:03, 2:43:10]: identifying appropriate funding for that. And I think that's that's kind of the the the point of our statement. But I think it's [2:43:10, 2:43:12]: You know, to say that [2:43:12, 2:43:32]: we're not getting things done. I mean I think we've just got b back from having a retreat, we went back and delineated all of the accomplishments that have been done. You know, the one of the things I I I I take solace in is um when we have the Citizens Academy, I often ask, you know, one of the standard questions it with with folks is how many staff members do you think we have here in the city of Stock? [2:43:32, 2:43:44]: Bridge and usually the answer is about one hundred and twenty, hundred and fifty, you know, two hundred in some cases. And they're they're blown away when tell them it's seventy people and it and it really is. I mean that we we do operate and function in a very lean capacity. [2:43:45, 2:44:05]: A large parti a large reason for that is because we don't have property taxes certainly. Um so that does s limit uh some things we can do we have funding for to do. But again, staff is here to carry out the wishes and goals and and and and and and and objectives as stated by the council, but we also have responsibility to let you know and give you our opinion. [2:44:05, 2:44:21]: opinions on uh you know how we think a process should go, but at the end of the day, it's you all responsibility to set that course of action and we figure out how to get it done. And that's you know, we're not deviating that, we're not trying to stir you away from that in any way, shape or form. [2:44:22, 2:44:42]: issue tonight will be if this is the direction the council wants to go in, then the next co comment would need to be well how do we how do we how do we look at funding? I would think that would be the direction and but the thing about it is budget. So I would think as we continue down the road with budget for the budget of twenty seventeen this would be have to be part of the conversation on how do you fund this because right now the way I [2:44:42, 2:44:47]: stands, even if we want to do this now and get it going now, where would the money come from? Well it it's not budgeted. [2:44:47, 2:44:51]: So we would have to get it in the budget first before we do some massive type of [2:44:51, 2:44:54]: budget amendment and and maybe mess something up. So [2:44:54, 2:44:57]: Uh that's my thoughts on it. I think if we can do this without [2:44:58, 2:45:10]: being part of the comprehensive plan initially and get moving on it, probably a good thing to do. But funding, how we refund it. That comes from our conversation as we develop the the plan for twenty seventeen. I think that's probably the best way to [2:45:10, 2:45:17]: to to approach this. That's just my simple comment. But uh I mean I don't know if everybody would be agreeable to that in that aspect. [2:45:18, 2:45:18]: Um [2:45:18, 2:45:24]: But what not. But this is a discussion uh process here. But any other comments, yes sir. [2:45:24, 2:45:44]: If we might be able to have Miss Neighbors come up and kinda talk to us about it. She did send me an email about it. Of course, uh this was not a budgetary item, but uh of course we we do have um fund balance uh that we could take this allotment from. I suggested to Miss Um Neighbors maybe we would look at [2:45:44, 2:46:04]: maybe doing um uh fund balance adjustment this time and then actually allocating the money reallocating the money in the twenty seventeen budget by advance. Her recommendation was to take the money from fund balance. But my recommend my considerations were in my non accounting mind was to say [2:46:04, 2:46:24]: We would advance the money to ourselves out of fund balance, but put a line in the budget budget for two thousand and seventeen uh replenishing the fund budget fund balance. Okay, so did one one second please. So you're mentioning that did you have a comment that you wanna uh since you uh you brought you up here, you have a comment to that? Well either way it's gonna come out [2:46:24, 2:46:31]: a fund balance if it's not budgeted unless we go ahead and put it in the twenty seventeen a line item there [2:46:31, 2:46:33]: That will pay for it. [2:46:34, 2:46:36]: All right. Okay, go ahead, sir. [2:46:37, 2:46:41]: Well that w that was gonna be my m my question is uh y [2:46:41, 2:46:47]: With the with the budget that we're working on now for twenty seventeen. Let's put it in the you know, because I [2:46:48, 2:46:53]: Even though we're looking good when it comes to fund balance, I would like for it to be as [2:46:53, 2:46:58]: You know, but if we could you saying that we would line item it? [2:46:59, 2:47:03]: Now. [2:47:04, 2:47:07]: You know, you wouldn't pay for it until twenty seventeen. [2:47:07, 2:47:09]: So you would put it in a line there. [2:47:10, 2:47:11]: In twenty seventeen. [2:47:12, 2:47:15]: Okay. Were you aware of that, Mr. Hall? [2:47:16, 2:47:17]: Where I'm not sure what the statement is. [2:47:18, 2:47:38]: You made a statement that we didn't have the money to do it. Were you aware of this project? No. I my statement was it we didn't have the money allotted for this. It's not in the present budget. In the twenty sixteen budget. Oh yeah, I I I agree I totally one hundred percent agree with the twenty sixteen budget. It was it was made prior to us coming into office and with this council and aggressive not only as a newly [2:47:38, 2:47:52]: elected it has been but the uh the incumbents have been pretty aggressive on what we want to do in the city. So uh you know there's means to make this because we've talked about overlays since I've been in office. And if there's uh and I know it's a separate it's a [2:47:52, 2:48:04]: it's a component outside of the comprehensive plan. Um but it's definitely been talked since I've been in office and I'm I'm understanding it's been talked prior to it. So if there's something that could be done to make [2:48:04, 2:48:17]: make this happen because w it is concerns of uh I think it's a consensus of the s of the council and it is concern of all of us. And I think the right thing to do is put it in twenty seventeen budget and you know it just becomes part of our systematic budgeting. [2:48:18, 2:48:19]: I agree totally with that. [2:48:21, 2:48:22]: Yeah. [2:48:23, 2:48:43]: No comments, you have no comments? Any other comments, sir? Well, I I just want to confirm what was just said. We th that it is okay if we could start about it now and then put that line in the twenty seventeen budget to we take the money initially from the fund balance. Well we wouldn't pay for it, so we wouldn't take it from fund balance. So you wouldn't do both. Okay. So what what I'm saying [2:48:42, 2:48:50]: minutes to get the project started. You can say to do that. And then we would pay for it out of a twenty seventeen budget. Right, right. [2:48:50, 2:48:50]: Uh [2:48:51, 2:49:07]: But you wouldn't have to do fund balance in the twenty seventeen. Okay, so we could pay for it we could start the project and then pay for it in the twenty seventeen. When the services were complete. Well we go ahead and start it. Okay. Okay, well well I guess the question would be just if they're gonna need some funding up front. [2:49:07, 2:49:10]: Or not. I would imagine they're gonna [2:49:11, 2:49:20]: Typically for a contract like that they're gonna want something or progress payments as you go. So it just depends on how that could be worked out. [2:49:20, 2:49:24]: That was our that's why I was saying, you know, we put whatever we take out now [2:49:25, 2:49:39]: We put something in the twenty seventeen month budget to put it back is what I'm saying. What if we take some money out to advance it, we have maybe two lines. We got one line that says w wh you know, we advance whatever we advance this year. [2:49:40, 2:49:44]: So that would literally be making a budget amendment in twenty sixteen. Right. [2:49:45, 2:49:49]: But whatever we take, we agree we agree to put the money back. [2:49:50, 2:49:55]: into the whatever if we take some money out, the money that he suggests in there, we agree to put the money back. [2:49:56, 2:50:03]: in a line in the twenty seventeen budget so that money is replenished. It's not actually going down. [2:50:04, 2:50:07]: But then that goes into the [2:50:08, 2:50:11]: But that goes into another discussion that we have we have to have [2:50:12, 2:50:14]: is when it comes to general funds. [2:50:15, 2:50:18]: And we haven't we haven't had that discussion. So [2:50:20, 2:50:26]: How do we know what we can pay back until we get to the discussion of general funds to know what general funds is? [2:50:26, 2:50:28]: to have that available. [2:50:28, 2:50:32]: Well then we would need to know what the timeline of the payment. If there is a payment [2:50:33, 2:50:36]: up front then we would have to do a budget amendment for twenty sixteen. [2:50:37, 2:50:41]: And then we would also have to have the remainder of it. [2:50:41, 2:50:44]: in a budget budgeted line in twenty seventeen. [2:50:45, 2:50:53]: I would w with that being said, I w I think we need to have a discussion on pertaining to general funds because w we don't want I I personally don't want to s [2:50:54, 2:51:08]: If there's a way to do it and then I thought that's why you came up. But I don't I don't wanna do any more I don't want I don't want to amend the six twenty sixteen budget anymore. Then I just really add in a line in twenty seventeen and go forward with the project in twenty seventeen. [2:51:08, 2:51:23]: Mayor Pro Timothy May. Well yes you can. Just one second though. That's why I said originally I I'm thinking that we what do we do, we when we have a budget discussions, we we plan to fund this project in twenty seventeen and not fool anymore with our twenty sixteen budget anyway.
