[0:05:29, 0:05:39]: that this is a special use permit for a gasoline station, but we learned yesterday that there's a distance requirement separate from SUPs uh that [0:05:39, 0:05:59]: that it appears that we're too close to another gas station, but we need to pursue a survey, take a look at the situation. We just learned of this yesterday, so we'd like sixty days to iron that out. Um and so w I ha I'm happy to answer any questions, but that's the reason for the deferral. And I think we should have it wrapped up in within sixty days. [0:06:00, 0:06:00]: Thank you. [0:06:01, 0:06:03]: Thank you very much. Thank you. [0:06:31, 0:06:35]: It's unanimous. I have it. This case is deferred. [0:06:39, 0:06:41]: Mr. Williams, did that satisfy you, sir? [0:06:41, 0:06:42]: Chaos. [0:06:42, 0:06:43]: Thank you. [0:10:36, 0:10:43]: Additionally, there were ten parcels that were de annexed from the city. This was in Manderley subdivision, and you can see that outlined in red on the map. [0:17:14, 0:17:15]: The first case [0:17:17, 0:17:23]: Is the resulting case RZ twenty twenty four dash zero seven for Patrick Heron Master Plan? [0:17:24, 0:17:27]: be located in Council District five. [0:17:28, 0:17:32]: Consideration of the Patrick Henry Parkway Master Plan. [0:17:33, 0:17:37]: Which was presented, which was prepared, I'm sorry. [0:17:37, 0:17:40]: Paired by the T S W Consulting Firm. [0:17:41, 0:17:45]: It proposes a mixed mixture of retail commercial [0:17:46, 0:17:49]: Residential and entertainment uses [0:17:50, 0:17:53]: For areas along the southern end of Patrick Henry Parkway. [0:17:54, 0:17:57]: For some properties lying within the city. [0:17:58, 0:18:05]: within Stockbridge City limits and others lying within unincorporated Henry County. [0:18:08, 0:18:09]: That's to be presented by Ms. Jackson. [0:18:11, 0:18:13]: Good evening, Commissioners. [0:18:14, 0:18:34]: Before you, we have a citywide rezoning um located on Patrick Henry Parkway. Um as the chair read into record, um, well, I'll read into record the parcels that will be affected by this rezoning. Um so it will be parcels zero five two, zero one. [0:18:34, 0:18:54]: zero two two zero zero zero that consists of twenty nine point eight acres zero five two zero one zero three one zero zero one zero five two zero five two dash zero one zero two three zero zero two [0:18:54, 0:19:05]: Um they consist of six point sixteen acres, zero five three B as in boy, zero one zero three zero zero zero six. [0:19:06, 0:19:26]: Consist of ninety two acres, zero five three B zero one zero three zero zero zero seven consists of forty eight acres zero five three B zero one zero three zero zero zero eight consist of four point four zero. [0:19:26, 0:19:28]: Yeah. [0:19:28, 0:19:48]: Zero five two dash zero one zero three one zero zero zero consist of four point three zero acres and the last one is zero five two three B zero one zero three zero zero zero nine consist of zero point zero. [0:19:48, 0:20:07]: In total, the acreage is approximately 41.68 acres. These properties are zone RR, which is rural residential. The city is proposing to rezone these properties to PUD, which stands for Planning Unit Development for a Midst-Use Development. [0:20:09, 0:20:20]: So the majority of the construction in Stockbridge uh occurred between 1980 and 1999. At 50 percent um [0:20:21, 0:20:25]: followed by thirty five percent between two thousand and two thousand nine. [0:20:26, 0:20:46]: Only 10% or shall I say 11% between 2010 to 2019. I say all of this to say is that this development will definitely change the population of the city of Stockbridge. We are in need of new development, precisely misuse and commercial properties. [0:20:46, 0:21:06]: Many of our residents have to go outside of the city to for entertainment, sit-down restaurants. So this development will definitely present the goal that we're trying to seek. This development will also be beneficial to the residents of unincorporated Henry County as well. The population [0:21:06, 0:21:26]: Goals for the city is to protect and enhance the city's unique qualities while embracing growth and ensuring that all residents have access to critical services, safe and attractive neighborhoods, and work opportunities. We also have a goal of to maintain a friendly and [0:21:26, 0:21:31]: environment and focus on attracting and retaining young professionals. [0:21:36, 0:21:54]: So as mentioned earlier, the city is seeking to rezone the property from RR to PUD to allow for misuse development. The subject property is 41.68 acres, consists of eight parcels that were read into the record um minutes ago. [0:21:54, 0:22:02]: The properties are located in District 5, Landlot 46. There are various owners of these properties, and they are [0:22:03, 0:22:07]: in agreement and have assisted staff in the process of rezoning. [0:22:08, 0:22:28]: The surrounding zonings, as you can see in the staff report, does consist of PUD, multi multiple uh family residential. We have also single family surrounding these properties. Um in the unincorporated Henry County, um, there are single family. [0:22:28, 0:22:32]: Commercial um on the southeast portion. [0:22:33, 0:22:44]: From this property is a PUDC2, which is general commercial. And on the west side, outside of the city, there is a zoning of RD and RM. [0:22:44, 0:22:47]: Um, which is a residential duplex. [0:22:47, 0:22:50]: And Residential Multifamily by Henry County. [0:22:51, 0:22:53]: And on the south east corner. [0:22:53, 0:22:59]: Also outside of the city, the properties don't see too commercial in Henry County. [0:23:00, 0:23:07]: The current land use designation is high density misuse, so therefore the city will not need to make changes to the land use designation. [0:23:09, 0:23:29]: To the southern eastern portion of the north, Patrick Henry Parkway, adjacent to I-75, is where this property sit. Um, it is also at the end point of Holloway Road. That's where um the property ends. This properties are vacant now, mostly wooded. Um so again, we [0:23:29, 0:23:31]: [1411.9, 1431.9]: Build a mixed use development that will consist of hotels, townhomes, single family homes, um also offices, commercial, retail. Um, just have that mixed use feel to the city, um, definitely bringing uh variety, bringing um different [0:23:51, 0:24:01]: land uses um to coincide with the area um to where it is headed as far as mixed use commercial. [0:24:04, 0:24:07]: So before you is the site plan. [0:24:08, 0:24:15]: As you can see here, that list the proposed development as well as the parcel numbers, the district. [0:24:17, 0:24:25]: And as you can see, um it is color coded. So I will attempt to read it to you. Um [0:24:26, 0:24:46]: The yellow part right now is showing apartments, but we may or may not do apartments in this area. We will focus on single family and townhomes. So this could change before development starts. So just FYI. You also have single [0:24:46, 0:24:57]: So family and townhomes to the south portion of the development. Um and I'll just go to the next screen so you can um [0:24:59, 0:25:08]: Look at the variations of the site plan before you. Again, these are conceptual plans. They're not final plans. [0:25:11, 0:25:26]: This is an aerial view of the map, um, pinpointing the properties that are in discussion tonight. So as you can see the red stars, um these are the two parcels that we are discussing as far as rezoning. [0:25:30, 0:25:36]: This is a zoning map of the parcels. As you can see, they are light yellow. [0:25:36, 0:25:39]: Um which is a indication of rural residential. [0:25:40, 0:25:45]: And the red arrow is just showing you where Holloway Road is located. [0:25:51, 0:26:11]: Before you is the Holloway Road at the endpoint of the properties, just to give you a idea what that area looks like. Um it's a little different today, but um if you look to your right, um if you're familiar with the racetrack gas station, that's where that that is located. [0:26:17, 0:26:22]: Again area view of the map with outline property. [0:26:26, 0:26:32]: This is the future land use designation as it is today, high density misuse. [0:26:36, 0:26:42]: And the next few slides are just concepts of what the development could look like. [0:26:47, 0:26:55]: So the city is definitely invested in bringing beautification to the city. Again, more uses, commercial uses, mixed uses. [0:26:56, 0:27:06]: This will bring jobs to both Stockbridge and Henry County as there will be commercial development, retail stores. [0:27:09, 0:27:25]: The city is looking for a vote tonight so that we can move this to city council on October fourteenth. Excuse me, October fourteenth. Um we are asking or seeking an approval. This concludes the presentation for tonight. [0:27:26, 0:27:27]: Thank you, Miss Jackson. [0:27:29, 0:27:31]: Any questions from the commission, please? [0:27:32, 0:27:39]: Actually, uh Mr. Chairman, I have a comment go right in and a question. So Miss Jackson, thank you first off. Um [0:27:40, 0:28:00]: I would very much be against the apartments. It seems like an unhealthy mix, personally. Uh I'd rather see townhomes, though I mixed on that myself. Secondly, the one third being retail, hotel, restaurant. Um you already have a healthy interest from retailers? [0:28:00, 0:28:07]: A particular hotel brand, anyone that is very interested in this, given the building that's taking place currently on Johtoco Road. [0:28:09, 0:28:29]: We do actually. We've had uh several um retailers companies to um show interest in this area. Um I'm not at liberty to discuss who they are. That's understood. Um nothing is finalized, but yes, to answer your question. Okay. Thank you. Yes, yes. Uh [0:28:29, 0:28:32]: Uh when it comes to entertainment, what type of entertainment uh [0:28:34, 0:28:54]: You're gonna love it. I can't tell you what it is. Um, it is an assigned exciting development. Um the city has been working on this for a few years. So now we're in the process of moving forward. I will say that um the same developers that did the bridges of Johtaco will be involved in this development. [0:28:54, 0:28:55]: Yeah. [0:28:57, 0:28:59]: Do you have a question? [0:28:59, 0:29:18]: Thank you again, Ms. Jackson. Um, I I have to agree with my colleague, looking at it overall, it kinda gives a chaotic state, just looking at it. Um, so do you all still want us to vote on it whether you guys do the apartments or not? Cause if we vote on it now, then it would be the recommendation of adding the apartments. [0:29:21, 0:29:35]: So this is a concept plan. Um the city has it is zoned PUD, so PUD will allow for these uses, whether we go with the apartments or the townhomes. Um I will say [0:29:35, 0:29:55]: Um is probably high highly that we will not go with the apartments. But again, this is a concept plan that was constructed at the time um thoughts went into this development. Okay. Uh thank you for that. I know the city manager came last meeting and kind of gave us an [0:29:55, 0:30:13]: overview. He did discuss something else coming in the project and taking out the if you go back to the map for the public, um taking out the single family and town host townhomes in the south, um, for something else to go there. Is that in effect or is it gonna stay as is on the map? [0:30:14, 0:30:16]: In regards to that that portion. [0:30:16, 0:30:35]: You are correct. The city manager um has more information regarding this development as he is one of the creators. Excuse me. He is one of the creators for this development. So I apologize. I'm not at liberty to say yay or nay. Um, but it is a possibility there could be [0:30:36, 0:30:54]: um a rearrangement, the single family could go at the top, vice versa, but at this time, um I believe townhomes, we are wanting to do a mixed use development that consists of r residential. So it is a possibility um the layout could change. [0:30:55, 0:30:56]: Okay. [0:30:56, 0:31:16]: Okay. I understand. Um, the development looking at the map, two was my last two. Is it correct that there's two or five rather entrances and exits inside of the plan? And then does the development go all the way up to the true by uh true hotel that's being built as well at the top of Patrick King? [0:31:16, 0:31:17]: Yeah. [0:31:17, 0:31:30]: Sure. Um it doesn't go all the way up to the true. So as you can see here, this is um Hollow Holloway Road and my cursor's not showing, but um if you see the red [0:31:31, 0:31:51]: Semicircle, it's not a semicircle, but the red dot, uh, for lap lack of better word. This is Holloway Road, and right below it is racetrack. I'm just trying to give you a visual. Yeah, if you move upward, um, this is the beginning point. So remember in 2019, I believe the [0:31:51, 0:32:02]: That was a previous rezoning of the property above it. Um, so it ends right there. Well, it starts right there and it ends at Holloway Road. [0:32:03, 0:32:06]: So true is further north. [0:32:13, 0:32:15]: Any more questions? [0:32:15, 0:32:15]: Mm-hmm. [0:32:15, 0:32:34]: May I speak. Mr. Chairman. Uh Ms. Jackson, could you explain exactly what a concept means when you do a layout like this? And also that area used to be an overlay district long time ago. Uh we also have an elderly uh [0:32:36, 0:32:45]: home that's coming down on that segment also on that particular end across from Georgia power also in that area. [0:32:45, 0:32:53]: We also have a hotel coming in that area also, but it's on the opposite end of what you're showing here on this map. [0:32:53, 0:33:13]: I I think uh the the issue that I'm seeing here is that we don't understand at least I don't ex understand exactly what what are you referring to as a concept map. If could you explain that please? Sure. A concept is uh like a vision. [0:33:13, 0:33:33]: You have a visual what you want to build, and you place that visual onto paper. So you may say, Well, I want landscaping here, I want um garage over there, um, I'm going to put my sidewalk. [0:33:33, 0:33:53]: Walk this way. So it's just a concept. It's not a final drawing of what you're proposing to build, but it gives the viewer or the reviewer. Um, in my case, I will be reviewing this. It gives me an idea of how you're gonna lay out your property, how you're gonna uh [0:33:53, 0:34:13]: Set up your setbacks, your height, the height of the building, um, what building materials you're going to go with for this development. So that's what a concept is. Again, we understand concepts change once you start your land disturbance. [0:34:13, 0:34:18]: and your grading that may change depending on the topography of the land. [0:34:20, 0:34:29]: So you're basically saying that this map is not concrete to what they m may do on this particular property. Am I correct to say that? [0:34:30, 0:34:50]: This may not be the final layout, but it's definitely concrete in terms of uses. So if the public is sitting here listening to this, then they may have questions to say. We don't want this or we don't want that. So that would be a concept with as far as what they want here and what [0:34:50, 0:34:51]: What they don't want there. [0:34:52, 0:34:57]: That is true. Um, however this is in the works. So I [0:34:58, 0:35:01]: And forgive me, city manager, if I say it wrong. [0:35:03, 0:35:05]: It's a high possibility is going to happen. [0:35:07, 0:35:27]: All right. Thank you, Ms. Jackson. You're welcome. Chair, if I may I have one more question. Go right ahead, sir. Um, Ms. Jackson, I'm looking at the the concept plan that was just given to us and then trying to defer back to the one given to us last meeting. Um, are we is the potential car dealership site if a [0:35:27, 0:35:31]: Allowed by zoning, is that being added concrete as well? [0:35:32, 0:35:33]: to this development. [0:35:33, 0:35:52]: So the car dealership I do not believe is going to happen. Um we have an alternative idea or plan that that is currently in the words. So is is it may not happen. Okay, perfect. Thank you. You're welcome. [0:35:56, 0:35:57]: Any more comments? [0:35:59, 0:36:06]: I just need to be clear, Miss Jackson. Exactly what are you asking us to do? Um [0:36:07, 0:36:26]: You asking us to approve the parkway master plan or you asked us to approve rezoning? I'm asking you to approve the rezoning. Okay. Now from what I have in front of me, there's eight parcels and I also understand that not all of the parcels are in [0:36:28, 0:36:29]: The city of Stobre. [0:36:32, 0:36:34]: So yes they are. [0:36:40, 0:36:45]: May I speak to you? In your agenda you say it and I'm gonna read what I see here. [0:36:47, 0:36:56]: It proposes a mixture of retail, commercial, residential, and entertainment uses for areas along the southern end of Patrick Evan Parkway. [0:36:57, 0:37:00]: Will some properties lying within the city limits? [0:37:00, 0:37:03]: And others lying within unincorporated Henry County. [0:37:04, 0:37:07]: Right. So the agenda. [0:37:08, 0:37:17]: Okay. So I'll be clear. Um, as I was stating before, the properties to the south, um, near Holloway Road, those are [0:37:18, 0:37:38]: Unincorporated Henry County. So yes, there are some unincorporated properties surrounding this. Like for instance, across the street, that is unincorporated Henry County. So I'm giving you direction as to where those properties are. So I'm giving you north, south, east, west, wet properties. [0:37:38, 0:37:40]: properties are surrounding these properties. [0:37:44, 0:37:49]: So of the eight parcels that you list in your staff report. [0:37:50, 0:37:53]: All eight of these lie in the city of Stockbridge. [0:37:53, 0:37:53]: Yes, sir. [0:37:58, 0:38:08]: We are not um able to rezone properties that are not in the jurisdiction or city limits of City of Subbridge. I'm with you on that. [0:38:09, 0:38:14]: I guess the the confusion I have the the map doesn't delineate [0:38:17, 0:38:20]: Which part of just development lies in the city and which part doesn't? [0:38:21, 0:38:34]: Okay. So if we go back to the screen that had the outline, so this is the future land use map. This shows the outline of the properties. Everything is outlined is in the city of Stockbridge. [0:38:36, 0:38:39]: And that consists of eight parts? Yes, sir. [0:38:40, 0:38:41]: Thank you. [0:38:42, 0:38:42]: Sure. [0:38:43, 0:38:56]: Mr. Chairman, I'd like to ask a question. Go right ahead. So then the the bottom portion portion here, uh, is there a plan by the city to try to annex that? And would there be changes to it based on the annexation? [0:38:57, 0:39:04]: Are you referring to Holloway Road? Yes. South of the uh road that's no longer in use or that was decommissioned for lack of a better word. [0:39:05, 0:39:08]: There are no plans to annex that portion. [0:39:10, 0:39:11]: All right, thank you. [0:39:18, 0:39:20]: One other question, Miss Jackson. [0:39:21, 0:39:34]: And I don't remember what meeting it was, but it's my recollection this parcel, these parcels came before us not too long ago for rezoning. Am I correct? [0:39:35, 0:39:41]: I believe you're referring to the annexation. There were four parcels. Is that perhaps. [0:39:41, 0:39:43]: Okay. Um [0:39:44, 0:40:04]: I can't remember what month. I may it may have been in July or June. There were there was a presentation that came before you regarding four properties on Holloway Road. Um the Henry County Board of Commissioners denied that annexation. However, um [0:40:04, 0:40:14]: Well, they denied the DNS station from Henry County. However, that applicant still wants to continue. So it will come back before you at a future date. [0:40:18, 0:40:19]: Okay. [0:40:23, 0:40:25]: Any more questions, comments from the Commission? [0:40:31, 0:40:32]: Thank you, Ms. Jackson. [0:40:32, 0:40:33]: You're welcome. [0:40:35, 0:40:37]: Is there someone here representing the African? [0:40:41, 0:40:42]: You there. [0:40:43, 0:40:44]: The CDU is the applicant. [0:40:46, 0:40:51]: So I guess we can open this up for public comments, the public hearing. [0:40:52, 0:40:55]: Mayor, would you take your seat till I call on you, please? Thank you. [0:40:59, 0:41:07]: What we're gonna do, we're gonna first ask for is there anyone here that's in favor of this development? [0:41:08, 0:41:12]: We ask that you fill out a form and approach the podium. [0:41:13, 0:41:14]: Make you can wince. [0:41:18, 0:41:24]: If there are not anyone in here in favor of it, then I wanna ask if there are anyone here opposed to it. [0:41:25, 0:41:31]: And I would ask you to do the same thing. Fill out a form, approach the podium, and make your comments. [0:41:37, 0:41:38]: You're good. [0:41:46, 0:41:51]: If you will give us your name and address before making your comments. Thank you. [0:42:03, 0:42:23]: My name is Connie Snow and I live at 426 Chase Marion Way, McDonough, Georgia. It's actually in the Eagles Crest subdivision, which is off Holloway. I wanna address a couple of things first. Um I've lived at my home for 20 years. In fact, my son's right here. It's the only home he's ever known. He went [0:42:22, 0:42:42]: So he graduated from Eagles Landing High School. This young lady's his girlfriend. She's from this area as well. They've watched this area develop and change. What's really sad to me is I remember when he was in elementary school, he came home one day so excited because he had learned something at Flippin' Elementary about the uh Native American Indians that lived off a patch of. [0:42:42, 0:42:56]: Patrick Henry and the reason why they did is because of the creeks and the streams and how they could survive off eating off the land there. There's tons of creeks and streams still in that area. And by building this development, we're gonna endanger that ecosystem. [0:42:58, 0:43:18]: Massively. Um, some other things I want to touch on real quick. Um, so you say we're not a part of the city of Stockbridge and there's no plan to annex us, but that's not true. Per SB 612, which if you look it up and you look at the parcels list in it, my neighborhood and that parcel ID is on there for the list. [0:43:18, 0:43:38]: List of potential annexations, something that I'm pretty sure was not on my ballot to vote for, but that's for another day or another time. Um additionally, I've spoken on this property about four or five different times that we've had meetings and we keep going back and forth. We were told they were investors, developers, what have you, but tonight we've been told [0:43:38, 0:43:58]: Is the city. So nobody's really been clear to us on the intents or the plans. They've changed multiple times. Additionally, some other things that are very troubling to me that I want to bring up too is the fact that this development is in walking distance of three schools. My home sits directly behind Eagles Landing High School in the [0:43:58, 0:44:18]: football field and the vast majority of the students in that neighborhood in the surrounding area and middle and high school walk to and from school. I have brought that up several times in every meeting, so much so that last year at one of the meetings, the mayor told me that why he cares about the kids because the school is on county land. It wasn't essentially [0:44:17, 0:44:37]: His problem. Not his exact words, but that's what he said. Please go back and look at the tapes. You'll see it for yourself. Here's what's going to happen: we're going to keep building. We're going to damage our ecosystem because there's so much water around there. And because of all that development, it's going to end up flooding my neighborhood, the other houses, the schools. Again, there's Eagles Landing, Middle School. [0:44:37, 0:44:48]: School, high school, and Fliplin Elementary, as well as NOAA's Art Daycare and a private school church that's over there. So we're gonna damage a lot of stuff by doing this. [0:44:49, 0:45:09]: Another thing, um, in twenty eighteen we were rezoned without our knowledge. We found that out through my battle over this development last year. And we were rezoned for the rehabilitation center listed on Patrick H Henry. It should be interesting to know that the person over that is Southern Consulting, also known as Jeff Grant. [0:45:09, 0:45:29]: It should also be interesting to know that Jeff Grant's over the development of the bridges of Jodico. He served five years in pr prison for development fraud in the state of Georgia, relating to the timber industry. And in 2013, he served a civil suit for bank fraud and forgery and development crimes for something off mill. [0:45:29, 0:45:49]: Road that the Henry County citizens had to pay for. So I I have to ask this question: why do we keep approving these criminals to build faulty bills and development? The applicant you have listed is Lenar Holmes. In 2018, Lennar Holmes was served with a civil lawsuit. And that civil lawsuit, it was alleged. [0:45:49, 0:46:02]: that they had defective construction, faulty plumb plumbing, and construction defects that led to safety concerns and injuries injuries injuries, among other civil lawsuits due to faulty bills. [0:46:05, 0:46:25]: I see um Southern Consulting also works with property owners such as the Chen family, who was a part of the Bridges of Jodico, and I do believe he works with the Patels, who are some of the applicants on these as well. Here's what's gonna happen. Clayton County lost their accreditation, their school accreditation to these same developers years ago. They're still recovering. [0:46:25, 0:46:45]: Property owners' values went completely down. And it's the same people like Jeff Grant, Tim Jones, and all these others that were involved that caused that. And we as a county are now approving that. I don't know if you've looked at the recent data, but Eagles Landing High and Middle are failing, man. And so are most of our Henry County schools. Once those schools fill, [0:46:45, 0:46:56]: Our property value crumples. Additionally, the goal of the city of Stockbridge is to tad my home out and put me in a blighted district. My neighborhood's not blighted. [0:46:56, 0:47:16]: Yeah, I've got some homeowners that probably should cut their grass and not do the things that they do, but it's not blighted. And he's gonna do that, the stock bridge is gonna do that by building this development and everything else you're talking about in order to decrease every property owner's value in there. And currently there's forty-eight percent ownership, with a majority of that ownership being [0:47:16, 0:47:21]: senior citizens. So essentially this is another form of imminent domain happening to us. [0:47:22, 0:47:42]: I know you guys can say no and they're still going to improve it, but I want it on the record today that the people that are behind this development is Jeff Grant from Southern Consulting. He is what paved the way for the FLMU to be changed in 2023. We were secretly put on SB612 without our knowledge. We were not. [0:47:42, 0:47:58]: told at previous meetings that the city of Stockbridge was the lead development over this. I want to also be noted that Southern Consulting donates a lot to certain persons, charity on this committee. With that being said, that's all I have to say. Thank you. [0:47:59, 0:48:01]: Thank you. Is there anyone else? [0:48:06, 0:48:10]: There's no one else in the public hearing for this case it's closed. [0:48:24, 0:48:26]: Mr. Chair, may I [0:48:27, 0:48:28]: Go right in here. [0:48:29, 0:48:49]: I just want to point out that Miss Snow does not live in the city of Stockbridge. She lives in unincorporated Herring County. Her property is near Eagles Landing High School. We are not intending to rezone or in annex those properties within the city. So I just want that to be clear. [0:48:49, 0:49:00]: As far as the statements made about the flooding, she spoke with Mr. Gartner at the last presentation that was made, and he addressed that to her. [0:49:02, 0:49:03]: I yield. [0:49:04, 0:49:04]: Yeah. [0:49:05, 0:49:08]: May I speak, Mr. Chairman? Go ahead ahead, sir. [0:49:08, 0:49:14]: Um, I I kinda heard him mention something about uh Indian [0:49:14, 0:49:21]: area uh in that segment that we're talking about. Is there any form of Indian burial ground in that area? [0:49:21, 0:49:23]: That's the first taxing on the acknowledgement. [0:49:24, 0:49:25]: May I please? [0:49:28, 0:49:35]: I I'm just asking the question to see if there's anything that's valid and in reference to that, if you don't mind. [0:49:36, 0:49:38]: Not to my knowledge, Mr. Tippodeau. [0:49:40, 0:49:40]: All right, thank you. [0:49:45, 0:49:48]: I need a motion please from the co commission. [0:49:48, 0:49:49]: Yes, Mr. Chairman. [0:49:50, 0:49:52]: I would like to make a motion of that we [0:49:54, 0:49:55]: Read on case. [0:50:00, 0:50:01]: Four. That's why seven. [0:50:04, 0:50:05]: Is is there a second? [0:50:12, 0:50:19]: Mr. Chairman, I second the motion. It's been moved by Mr. Thomas and seconded by Mr. Meaden. [0:50:21, 0:50:26]: That we approve case R Z twenty twenty four dash zero seven. [0:50:26, 0:50:29]: All in favour let it be known by the sound of I [0:50:29, 0:50:32]: No. [0:50:35, 0:50:47]: We have Mr. Thomas, Mr. Mitton, and Mr. Williams voting in favor of approval. Mr. Thibodeau voted against approval. [0:50:48, 0:50:49]: No, I didn't vote against it. [0:50:50, 0:51:01]: I'm sorry. I didn't vote against it. Did you vote at all? Yeah, I did vote. You voted in favor? Yes. Okay. Then it's unanimous. We have four yes and zero nays. [0:51:02, 0:51:04]: May I speak, Mr. Chair? [0:51:04, 0:51:05]: Yes, you may. [0:51:05, 0:51:08]: even though we we made uh [0:51:08, 0:51:26]: pass this or whatever however you want to call it. At the end of the day, this board does not have the last say so when it comes to any ruling that we make. It is the city council that can approve or not approve anything that we may pass for whatever reason. [0:51:28, 0:51:29]: Thank you, Mr. Turbano. [0:51:32, 0:51:33]: Next case is [0:51:35, 0:51:40]: Text amendment case TX twenty twenty four dash zero five. [0:51:40, 0:51:41]: City wide. [0:51:42, 0:51:44]: So consideration of a text amendment [0:51:44, 0:51:48]: to section two point four point four [0:51:49, 0:51:53]: of the Stockbridge Unified Development Code, the UDC [0:51:56, 0:52:03]: to modify and augment the regulations for a multiple family residential zoning district. [0:52:04, 0:52:05]: This Jackson Police. [0:52:06, 0:52:15]: Greetings again, Planning Commissioners. Um, thank you for allowing me to come before you to present to you. [0:52:16, 0:52:35]: The regulations in regards to multiple family residential district. Um, as you read into the record, this contains to section two point four point four and what the intent here is to modify this district to allow [0:52:35, 0:52:55]: um additions to various sections of the UDC and to um create a more um acceptable building standards. So section one of this district states that various sections, well there's various sections in the UDC [0:52:55, 0:53:02]: um that needs to be amended. One is the entitled multiple family residential district. [0:53:02, 0:53:07]: to a be to be amended to add another section under it. [0:53:07, 0:53:27]: As multiple family residential district design guidelines. Also, section 2.4.4. We are looking to amend a section titled Yard Setbacks, and we want it to read minimum front yard setback 30 feet. So as you are [0:53:27, 0:53:47]: aware um variances has come before you where developers have asked to reduce the front yard setback from 50 feet to 30 feet. One came before you last month where you well you denied it. But there were others that has come before you and you've approved [0:53:47, 0:54:07]: those requests. And we get a lot of those. So what we're wanting to do is amend this zoning district to allow for a more comfortable build with um developers um just to present a more um not restrictive development, if that makes sense to you. [0:54:07, 0:54:27]: And as you can see, this is the UDC portion that states what the structure should look like from the street. And I believe it's in your staff report as well, where this building is sitting 50 feet from the street. [0:54:27, 0:54:42]: MFR allows for townhomes, multiple family apartments. Sitting that sitting that building that far from the street does create more impervious surface, which could [0:54:43, 0:55:01]: create a hardship for the developer. Um most districts have a certain percentage of impervious surface that you cannot exceed. Um this could create a hardship for one who has to build that far from the street. So bringing it closer will [0:55:01, 0:55:07]: have less pavement, less impervious, um, that can use that for more beautification. [0:55:08, 0:55:10]: um of that building. [0:55:14, 0:55:34]: So again, I mentioned the front yard being reduced from 50 feet to 30, where other changes we're making is to add the requirement of flock cameras. Um again, before you variances or rezonings have come before you where we'll add that condition. Now this will be [0:55:34, 0:55:52]: just a requirement. That condition will no longer be needed. Flock cameras will be required when you're building townhomes on multiple family developments. Multi-use paths, we want to change that from eight feet to 10 feet. [0:55:53, 0:56:08]: Central garbage facility. We want to provide centralized garbage facilities for garbage and refuse collections for a certain number of units or percentage of the units. [0:56:09, 0:56:14]: Implement implementation of the JohtoCo design standards. [0:56:14, 0:56:34]: was used as to come up with these design standards. Um that came before you, I believe, in 2019, where there were design standards um created for the bridges of Jotaco. We're just pulling some of those standards and putting it into our MFR [0:56:34, 0:56:35]: Our district. [0:56:38, 0:56:43]: So in your staff report is a um sheet titled exhibit A. [0:56:45, 0:56:52]: you'll see these are current standards as well as proposed standards. [0:56:58, 0:57:18]: So the front yard setback was one. We're also changing the side yard setback from 15 feet to 10 feet. Currently, our code states that the side yard has to be 15 feet and there must be 20 feet between the buildings. Mathematically, it doesn't make sense. So we're drawing. [0:57:18, 0:57:26]: Dropping the side yard to 10 feet so that you can have that easy transition of 20 feet between the buildings. [0:57:27, 0:57:41]: Also in the minimum living area section of Exhibit A, um, previously you saw that the studio is 800 square feet, whereas the one bedroom was 650 square feet. [0:57:42, 0:57:49]: That didn't make sense either. So we decided to make amendments to that, just switch it around, whereas the studio [0:57:49, 0:57:57]: now has a minimum square footage of six hundred and fifty, whereas the one bedroom would now be eight hundred square feet. [0:58:00, 0:58:20]: And I've already mentioned the multi-use paths as well as the garbage facility. And I mentioned the flock cameras. Um, below that are some of the architectural language from the bridges of Johtaco. Again, we're just kind of snipping that from that um development. [0:58:20, 0:58:39]: In inserting it in the MFR district. So we do ask that you approve these changes and so that way we can reduce some of the variances and allow for more beautiful development of townhomes. Thank you. [0:58:39, 0:58:40]: Thank you, Ms. Jackson. [0:58:43, 0:58:44]: Any comments from the Commission? [0:58:48, 0:58:48]: No comments? [0:58:50, 0:58:52]: Mr. Anderson, does this require public hearing? [0:58:54, 0:59:00]: Yes, it w it w it will require a public hear hearing um tonight and at city council. Okay. [0:59:01, 0:59:05]: And in that case the floor is now open for public comments. [0:59:07, 0:59:25]: I'm gonna ask anyone who wishes to s speak regarding the Text Amendment case twenty twenty four-zero five, if you would uh fill out a form if you haven't already done so. Approach the podium and give them your name and address and make your comments. [0:59:29, 0:59:32]: Seeing none, the public hearing is now closed. [0:59:35, 0:59:45]: I need a motion from the council, please. Chair. Go ahead and yes, sir. Motion to approve text amendment case TX dash two hundred and twenty four dash oh five citywide. [0:59:45, 0:59:47]: Is there a second? Second. [0:59:48, 0:59:51]: Mr. Williams has made a motion to approve. [0:59:53, 0:59:55]: Mr. Thomas has second the motion. [0:59:56, 0:59:58]: All in favour, let it be known by the sound of I. [0:59:59, 0:59:59]: Uh. [1:00:00, 1:00:01]: Email poles. [1:00:03, 1:00:05]: It's unanimous eyes have it. [1:00:06, 1:00:08]: The text from the case is approved. [1:00:09, 1:00:09]: Thank you. [1:00:16, 1:00:23]: Next item is a special use permit case SP twenty twenty four-zero two to be located in Council District Four. [1:00:26, 1:00:27]: Consideration of a [1:00:28, 1:00:30]: Special use permit to allow a liquor store. [1:00:31, 1:00:34]: On the property at one hundred six Rock Quarry Road. [1:00:35, 1:00:38]: Applicant GRP L C [1:00:39, 1:00:43]: The agent is the Gershkumar Patel. [1:00:44, 1:00:55]: Property is located in Land Lot sixty two of District twelve. It contains point eight nine acres more or less. Mr. Linton, please. [1:01:00, 1:01:11]: Thank you, Mr. Chairman. Um the presentation I will be making tonight is S B twenty four dash zero two, which is for a special use permit for a proposed liquor store at one oh six Rock Cory Road. [1:01:15, 1:01:35]: The case facts. The applicant is GRP LLC. The owner is North Eagle Pavilion LLC. The agent is Gorish Kumar Patel. And as mentioned, the address of the property is 106 Rock Court Road, with the number of acres being 0.89. As far as the project characteristics, there is the [1:01:35, 1:01:36]: An existing building. [1:01:38, 1:01:49]: With an existing business on the property, the current future land use designation is Low Density Mixed Use and it has a current zoning of C two and the sign was posted on august twenty first, twenty twenty four. [1:01:51, 1:02:02]: And this is the vicinity map and here highlighted is one um the building and they will be utilizing the other building um adjacent which is located in the green star. [1:02:08, 1:02:10]: And this is the aerial photo with the side plan. [1:02:16, 1:02:20]: And this is when we posted the sign on august twenty first, twenty twenty four. [1:02:24, 1:02:25]: And this is the zoning map. [1:02:27, 1:02:39]: The subject property is currently surrounded by C2, LI, which is light industrial, heavy industrial, MFR, which is multifamily residential, and OI, which is office institution. [1:02:41, 1:02:50]: And this is the future land use map. The subject property is surrounded by the D T on the left, low density mixed use, and heavy industrial, which is located below. [1:02:53, 1:03:13]: So, to give you a backstory on the uh application, um the city recently had a lottery applic application for 45 business days to award two additional alcohol before this licenses due to the recent growth of the city population. The applicant was awarded on July 30, 2024, and applied. [1:03:13, 1:03:27]: Apply for a special use permit uh in August. So right now, right before you is the map of the existing liquor stores. Uh currently there are four with um which are highlighted in red, and the one in green is the proposed liquor store. [1:03:32, 1:03:52]: And so we did a comparative analysis to look at the current uh liquor stores and compared it with the proposed liquor store. And the zoning, um, all of them are C2. And the current future land use, uh, except for JJ liquor store, is medium density mixed use, while the rest are low density mixed use. And this [1:03:52, 1:04:00]: Square footage, they aligns with the uh the proposed to use aligns with the current um liquor stores. And as far as the number of parker spaces, they align as well. [1:04:02, 1:04:10]: And so this is the liquor store uh the Stockbridge Bottle Shop, which is located at five zero three nine North Harrington Boulevard, Suite C. [1:04:12, 1:04:18]: This is the other liquor store, uh, Eagles Landing bottle shop, located at one hundred Eagle Landing Parkway. [1:04:21, 1:04:25]: This is the JJ Liquor Store located at 1590 Hudson Bridge Road. [1:04:26, 1:04:31]: And this is the Highway one hundred thirty eight package store located at twenty twenty eight Highway one thirty eight West. [1:04:35, 1:04:51]: The zoning history of the property. The subject property was rezoned from R three residential to C two General Commercial on January twenty ninth, two thousand one, upon the request of OPM properties, the intent of the request for for a retail slash warehouse building. [1:04:54, 1:05:14]: The proposed uh development information. GRP LLC is seeking a special use permit to convert a twelve thousand five hundred foot square foot building at one hundred six Rockquarry Road into a liquor store. The planned improvements include resurfing the parking lots, enhancing landscaping, adding brick facades, and installing [1:05:14, 1:05:32]: The project is expected to be completed by December 25th, 2024. The property is zone C2, which permits the castore under section 2.49 of the Stockbridge Unified Development Code and must comply with the development standards. [1:05:37, 1:05:40]: And this is the side plan showing the two buildings that they'll be utilizing. [1:05:45, 1:05:48]: And this is the rendering of the building once it'll be complete. [1:05:53, 1:06:13]: And so we did uh we we looked at the other regulations that's relevant to request. We looked at OR twenty-four five six three, section two point five two C and two point five two D of the Parquet Mix Use Overlay District. We also looked at the OR twenty-four five six zero, which is certain business require certain businesses. [1:06:13, 1:06:27]: And chapter 9.04070, license district restrictions, section 9.25, requirements for the special use permits, and section 9.26, which is a use permit consideration. [1:06:32, 1:06:40]: And so we looked at OR, as mentioned, OR five six three, section two point five D of the Parkway Mixed Overlay District. [1:06:40, 1:06:53]: Currently the subject property is in the Parkoway Mixed Use Overlay District, and the Stockbridge City Council passed a text amendment on May 13, 2024, which amended the PA the Parkway Mixed Use Overlay Guidelines. [1:06:56, 1:07:16]: And the proposed liquor store complies with section 2.52C as a select use. The key points to highlight is that the property fronts Rock Cory Road, which is classified as a minor arterial road by the Georgia Department of Transportation, is Zone C2, which permits liquor stores. The proposed liquor store will feature brick [1:07:16, 1:07:25]: Facade on all sides, which meets the required improvements, and the store will utilize the existing internal lane for access and internal circulation. [1:07:29, 1:07:35]: We also looked at OR twenty four five six zero certain businesses, uh section B. [1:07:37, 1:07:57]: Which was an ordinance that was passed by Mayor Council on march twenty sixth, twenty seventy four, which specifies that a liquor store must occupy at least six thousand square feet to be eligible for a license. The proced liquor store at one hundred six Rockware Road, with a total area of twelve thousand five hundred square feet, exceed this requirement and thus complies with the OR twenty four five six zero. [1:08:03, 1:08:10]: And we also mentioned the chapter nine point zero four zero seven zero, which is the licensed dist distance restrictions. [1:08:11, 1:08:31]: Um the churches, the alcohol sales are prohibited with within one hundred yards of any church. The three nearby churches are between three hundred forty-six and four hundred and eighty-eight yards away, which meets this requirement. As far as the schools, which states that it cannot be cannot occur within two hundred yards of any school. [1:08:31, 1:08:51]: Bridge Elementary School and Faith Academy are 629 and 429 yards away, respectively complying with this rule. And alcohol treatment centers, sales are prohibited within 100 yards of any state, county, municipally owned alcohol treatment center. HealthQuest Frontiers of Stockbridge is two point. [1:08:51, 1:08:54]: six miles away, thus meeting this requirement. [1:08:59, 1:09:12]: And it also mentioned the liquor stores. Distilled splits cannot be sold within five hundred feet of another lights in liquor store. The nearest liquor store is five thousand seven hundred five feet away, does complying with this regulation. [1:09:16, 1:09:21]: And this is a chart showing this is a table showing the distance restrictions. [1:09:26, 1:09:31]: And we uh created a map showing the distance to the nearby churches and the schools, which is shown here. [1:09:37, 1:09:46]: And we also created a dis a map showing the distance from the stockbridge bottle shop to the proposed liquor store, which is 5,705 feet. [1:09:46, 1:09:50]: Uh the bottle shop is is located in red and the proposed is located in green. [1:09:52, 1:09:56]: And this was the alcohol survey that was submitted as part of the application? [1:10:00, 1:10:05]: And we also looked at section nine point two five requirements for the special use permits. [1:10:06, 1:10:26]: The key points to highlight is that the store will utilize exist internal lane, which ensuring smooth traffic flow. The data from the Georgia Department of Transportation indicates that the average daily traffic count on Rock Croy Road was 12,500 in 2023, suggesting the current infrastructure can handle the additional traffic. [1:10:26, 1:10:40]: And that the property is designated for low density mixed use in the Stockbridge twenty four comprehensive plan. The proposed liquor store aligns with this designation and supports the plan's goal of promoting a better sense of place and preserving community character. [1:10:45, 1:11:05]: And we also looked at section 9.26, which discusses the use permit court uh considerations. The key points to highlight in this is that it aligns with the Stockbridge 24 Comprehensive Plan and it meets the intent of the low density mixed use designation, which aims to create community serve community-oriented [1:11:04, 1:11:12]: Commercial retail areas along the key corridors and intersection were serving by residential neighborhoods. [1:11:15, 1:11:19]: And it also aligns with the other community goals and policies which are shown here. [1:11:24, 1:11:38]: And it's come the properties zone C two, which is general commercial, which allows liquor store under section two point four nine of the stopbridge unified code. This zoning is consistent with the nearby set properties supporting the commercial character of the area. [1:11:40, 1:11:48]: And that the parking spaces will offer forty parking spaces meeting the requirements of section four point eight five of the stock price unified code. [1:11:52, 1:12:12]: This staff report has demonstrated that the requested special use permit via SP twenty four zero two is consistent with the regulations found in OR twenty-four five six three, OR twenty-four five six zero, chapter nine point zero four point zero seven zero, and both section nine point two five and nine. [1:12:12, 1:12:18]: point two six of the stop bridge unified develop phone development code. Therefore the planning and zoning staff recommends approval. [1:12:21, 1:12:23]: Thank you. Thank you, God. [1:12:24, 1:12:26]: Can we hear from the applicant, please? [1:13:05, 1:13:07]: Make this. [1:13:08, 1:13:17]: Good evening. I'm Lisa Morshauer. I'm an attorney with the law firm of Berman Fink Van Horn and I represent the applicant in this case. Um GRP [1:13:17, 1:13:35]: uh LLC is the applicant and I think that Mr. Anderson gave you exactly um the exactly what I want to say. His statement was was right um on every point. I um I reiterate what he said. Um the property is um well [1:13:35, 1:13:46]: We'll start with what happened with the lottery. The city determined that there should be a lottery to add new alcohol licenses based on the census. And my client um was able to get into the lottery. [1:13:46, 1:14:06]: And in order to be in the lottery, you had to have a location that met certain requirements, and this location met those requirements. So that was the first step. And then the lottery took place, and my client was one of the ones who was lucky enough to be drawn for the lottery to um pursue an alcohol license for a liquor store. So in order to do that, he has to submit, he had to submit. [1:14:06, 1:14:16]: Submit an SUP because you can't have a liquor license in the city of Stockbridge before you are um approved for a special use permit. So that is why we are here. And um [1:14:16, 1:14:36]: As Mr. Anderson said, the property is zone C2. It's it allows for a liquor store. The building itself meets the requirements for a liquor store. It has to be over 6,000 square feet. And it isn't um it's comparable to the other stores that are already licensed. [1:14:36, 1:14:51]: in size, it's about the same as almost all of those other ones. Um and they're and the zoning requirement is also the same. They're all they're zoned um for low density and commercial. So they the um [1:14:51, 1:15:11]: Criteria for this property and the building itself are very similar to the other stores that you have in this area, but there's not a store close by to this location. So this will serve an area that hasn't been served by well, people will probably have had to drive a distance to get alcohol if they wanted to purchase it. So now this store will be closer to other residents. [1:15:11, 1:15:22]: and um businesses in the area. As the city grows, that will be very important because your city is growing based on the census that allowed for this new store. [1:15:22, 1:15:23]: So [1:15:23, 1:15:27]: One of the things that you have to show is that um you're not going to be [1:15:27, 1:15:47]: impacting traffic and this location is um has a lot of access the road is um already utilized the traffic count will not be more it will not impact or increase traffic at all that's what the planning department found um there are other criteria that have to be met and um [1:15:47, 1:16:07]: Mr. Anderson spoke about all of them, but I'll just reiterate reiterate some of the ones that I think are really important. The distances to the various uses that are in the alcohol code, such as churches, schools, alcohol treatment centers, and other liquor stores. Those are all those distances are well beyond what the requirements require. [1:16:07, 1:16:21]: And they meet all of those requirements. The store itself is going to be transposed, it's going to be renovated. [1:16:21, 1:16:25]: Building walls will not change the eкster, but the ekster. [1:16:26, 1:16:46]: Facade is going to change. It's going to be much more updated. It's going to look really nice. It'll be a big improvement. Um, and it's not even a bad I I've seen a lot of ugly buildings. This is not an ugly building right now, but the um renovations will make it a beautiful building. The parking lot's going to be resurfaced, and there is green space. [1:16:46, 1:16:56]: Next to it, where there will also be new parking spaces. So there'll be ample parking for this this building, which is currently in use for retail right now. [1:16:57, 1:17:03]: And then um as far as use the use of it impacting um [1:17:03, 1:17:07]: the neighbor any any utilities that's not going to be an issue. Um [1:17:08, 1:17:08]: The [1:17:09, 1:17:20]: There's going to be better outdoor lighting. There are going to be protective well, there's gonna be new landscaping. So there'll be it'll be a better protected um screening from [1:17:21, 1:17:41]: the there are residences down the street, not close enough to impact the distance requirements, but that will be that'll be better. The landscaping is going to be very nice. You have the hours of operation for the store in the application. The proposed store will operate from 9 a.m. to 1030 p.m. on May [1:17:41, 1:18:01]: Mondays through Wednesdays, 9 a.m. till 11:30 p.m., on Thursdays through Saturdays, and on Sundays, 12:30 p.m. to 9 p.m., which are in line with all the other store hours of operation. And there will be open space. There will be ample open space around the building. And the inside of the building, obviously. [1:18:01, 1:18:05]: [4686.3, 4695.5]: nice you know, quality alcohol that'll be available for everybody in the in the city of Stockbridge and in Henry County to get. Um [1:18:17, 1:18:25]: Let's see what else I want to talk to you about. The ingress and egress to the property is is good. It has no problem at all. And um [1:18:25, 1:18:39]: It's compatible with the land uses and zoning um districts in the vicinity of the property. They're they're right in line with that and with the future land use map. Um it's in line with all of the requirements of the future land use map and the goals. [1:18:40, 1:18:41]: set out there in [1:18:41, 1:18:45]: So I believe that um based on all of these factors. [1:18:46, 1:19:03]: And the fact that it meets all the requirements of the dis the distances and the things that are in the alcohol code, we hope that you will approve the special use permit application for them and um and forward it with a favorable recommendation to city council. And um as a matter of just normal [1:19:03, 1:19:07]: Course, I have a a letter of objections in case for some reason you [1:19:08, 1:19:23]: you or the city council denied it that I'd like to submit into the record, but I'm not going to state them. I just have it in writing. So um we do ask that you vote favorably because we think it'll be a major improvement for that building and the community around it. And um and [1:19:23, 1:19:41]: The um Mr. Patel's son is here representing his father. So that's this is uh Naral Patel. If you have any questions of him, he's happy to answer them. But he but they've been involved with this kind of business before and I think they'll be a great operator and and a community member. I think they'll be a wonderful community member. [1:19:43, 1:19:45]: Do you have any questions? [1:19:48, 1:19:49]: Any questions from the council? [1:19:53, 1:19:54]: For questions? [1:19:55, 1:20:10]: And I d I have a s I don't know that you need it because I think the slideshow you got from the city is great, but I have a packet with slides or we had a PowerPoint, but it's basically the same that you already have in front of you. So I don't know if you need it. But I'm happy to have it handed out. [1:20:12, 1:20:13]: You wanna get it. [1:20:15, 1:20:19]: Provide'em to me. You I'll take them. [1:20:27, 1:20:28]: Yeah, better too. [1:20:28, 1:20:29]: Okay, too. [1:20:41, 1:20:44]: That's all I have. All right. Thank you very much. Thank you. [1:20:56, 1:21:00]: This item also requires a public hearing, so I will now open the floor. [1:21:03, 1:21:05]: For anyone in favor? [1:21:07, 1:21:09]: Of this proposal. [1:21:09, 1:21:10]: Yeah. [1:21:11, 1:21:14]: Seeing none, I will open for anyone that's opposed. [1:21:15, 1:21:16]: You are opposed? [1:21:17, 1:21:24]: I if you're able, would you please fill out a form if you have an hour dancer or if the podium give us your name please? [1:21:35, 1:21:54]: My name is Armenta Jones. I live at 612 Tahoe Trail in the city of Stockbridge. I'm opposed to another liquor store in the city of Stockbridge. Um I was gonna bring up where we had them, but [1:21:54, 1:22:11]: The gentleman already noted that, but um I just want to express my opposition to it. Um for young people and we just have enough liquor stores. And that's it. Thank you. [1:22:13, 1:22:14]: Any other comments? [1:22:16, 1:22:17]: Public hearings are now closed. [1:22:38, 1:22:40]: Are there any other comments from the commission? [1:22:42, 1:22:43]: Cheer. [1:22:43, 1:22:50]: Go right ahead, sir. Um I was gonna s is there gonna be any security measures for the development? [1:22:55, 1:22:55]: Right here. [1:22:56, 1:23:05]: Oh, it's in the it's I got it. I see it now. I didn't I didn't talk about that, but there is information in our packet about that. [1:23:05, 1:23:06]: They will have [1:23:07, 1:23:27]: um cameras inside and out. They will have an off-duty officer if needed during peak hours. They will have cash registers which require you input the birth date so that you can't bypass the birth date of anybody purchasing alcohol. The lighting is going to be upgraded on the property. And um [1:23:27, 1:23:36]: I don't I don't think I covered everything. They'll be they'll be they'll be IDing everybody and inputting it into the registration register. [1:23:37, 1:23:37]: Thank you. [1:23:44, 1:23:54]: I just have one comment before we take a vote. I won't be voting unless there is a tie. So what I have to say probably don't count for very much. [1:23:57, 1:24:01]: If they say didn't cost you nothing, probably not worth nothing. [1:24:01, 1:24:06]: But we wouldn't be having this conversation except for annexation. [1:24:09, 1:24:11]: I believe that's correct. [1:24:11, 1:24:12]: And [1:24:13, 1:24:15]: Нема обсевішн [1:24:16, 1:24:19]: There has not been any increase in demand for [1:24:21, 1:24:25]: for purchasing alcohol as a result of annexation. [1:24:27, 1:24:32]: If you recall, annexation was kind of designed to fill in some donut holes. [1:24:34, 1:24:35]: In the city map. [1:24:36, 1:24:43]: And if you look at it, all of those donut holes were already being serviced by the existing stores that we already have. [1:24:45, 1:24:53]: I'm not opposed to alcohol consumption. I've shopped at all four of the stores in Top Ridge. And my experience has always been pleasant. [1:24:55, 1:24:59]: But not everybody that got annexed in the city drinks. [1:25:03, 1:25:10]: And those that do were already being serviced by the four stores that we already have. [1:25:12, 1:25:18]: I haven't taken a poll of my colleagues. I don't know who they're thinking this. But uh [1:25:19, 1:25:24]: I would tend to oppose adding an audition store right now based on [1:25:25, 1:25:31]: the indexation because there hasn't been an increase in demand as a result of indexation. [1:25:32, 1:25:35]: For alcohol purchases. Those are my comments. [1:25:36, 1:25:39]: I need a motion from the Commission, please. [1:25:41, 1:25:44]: I'd like to present a motion that we uh pass it. [1:25:48, 1:25:50]: You are motioning for approval? [1:25:50, 1:25:54]: Is that what you're saying? Okay. Is there a second? Second. [1:25:55, 1:25:59]: It's been moved by Mr. Thibodeau and second by Mr. Williams. [1:26:00, 1:26:02]: That we approve [1:26:03, 1:26:05]: The special use permit case. [1:26:07, 1:26:11]: SP twenty twenty four dash zero two. [1:26:11, 1:26:13]: All in favor let it be known by the sound of I. [1:26:14, 1:26:15]: Aye. Aye. [1:26:15, 1:26:16]: In a post [1:26:19, 1:26:25]: We have Mr. Thibodeau and Mr. Williams voting to approve. [1:26:26, 1:26:31]: Mr Mitten and Mr Thomas voting to deny. [1:26:32, 1:26:33]: So we do have a tie. [1:26:36, 1:26:56]: So I will go ahead. Um, if I may, and I had this conversation with the attorney, um, for a public hearing case such as this, they can't we can't abstain unless we recuse ourselves from the bench before the discussion. Am I correct, attorney? That's correct. So so does he have to vote? [1:26:56, 1:26:58]: Or okay. [1:26:59, 1:27:00]: Yes. [1:27:01, 1:27:01]: Well [1:27:03, 1:27:15]: So so and I don't understand what you're saying. So according to the I and I can allow the city attorney to expound more, but according to the bylaws for the board [1:27:15, 1:27:28]: If you were to um if you were to abstain this vote, you would have had to ha do it before we started discussion and then you would have to accuse yourself to the general public since you didn't do so. [1:27:28, 1:27:30]: I didn't indicate what I planned to do. [1:27:31, 1:27:35]: Well, according to the bylaws. Uh m attorney, I'll can let you explain it more. [1:27:36, 1:27:41]: Am I am I wrong? I'm I'm I'm confused as to where the abstaining come from. [1:27:41, 1:27:44]: You said you were I never said anything about Obsani. [1:27:44, 1:27:50]: You said you were abstaining your vote for this. No, I said I would not be voting unless that was the tie. Okay. [1:27:51, 1:27:52]: That's what I said. I will break the tie. [1:27:54, 1:27:55]: Which I plan to do. [1:27:57, 1:27:58]: And I'm voting nay. [1:28:00, 1:28:04]: Ma may I speak, Ms Mr. Chairman? Yes, you may. [1:28:04, 1:28:16]: The only thing I have concerned about you making an assessment about whether or not Speak up, please. The thing I'm concerned about, you make an assessment about whether or not [1:28:16, 1:28:28]: the other liquor stores was serving the public. I I I think without stats and information, uh that's just uh a conversation per se. Um [1:28:30, 1:28:42]: We have an owner here that has qualified in all areas to uh be able to uh have a liquor store. So I mean that's what I'm basing my decision on, the qualification of [1:28:44, 1:28:45]: Business. [1:28:46, 1:28:50]: Uh it's uh matter of fact I'm a non drinker, so I'll share that with you also. [1:28:51, 1:29:00]: But if the business has rights to exist and it's not uh causing a problem in the area and they qualify on all levels, [1:29:01, 1:29:04]: Then this is how I see it, Mr Chair. [1:29:21, 1:29:41]: So that the absent member who is not here tonight can vote on this matter. So if we're not looking at an extension issue, we can certainly, this body can certainly continue this item to the next meeting so that there is not a title that issues, which you will have a full body to vote on the matter. [1:29:48, 1:29:50]: That is because there are less than six. [1:29:55, 1:30:03]: Mr. Chairman, if I can ask a quick question. So we're recommending body. This is going to go before the city council regardless next month. [1:30:03, 1:30:05]: So they could in effect pass. [1:30:17, 1:30:18]: Understand. Thank you. [1:30:19, 1:30:21]: If the applicant wishes us to. [1:30:24, 1:30:28]: And I actually would like that. I would like that. Very good. [1:30:28, 1:30:47]: Okay. So for the record the vote was two in favor and two against, and based on what the attorney has indicated with the applicant's request, we can defer this to the next meeting. [1:30:48, 1:30:51]: of the next meeting that there is a full commission here. [1:30:52, 1:30:56]: And the applicant has indicated that she wished to do so. So that's what we'll do. [1:46:20, 1:46:25]: Cheer. If I may, um I have a few questions. [1:46:26, 1:46:30]: Why was the business not approved by the state? [1:46:31, 1:46:39]: My business has never not been approved by the state. That is a lie. Whoever wrote it is a lie. I have a business license. [1:46:40, 1:46:43]: to my business where I am resigned right now in Riverdale, Georgia. [1:46:44, 1:46:51]: I am applying right now. I have not applied because the first phase they denied me. [1:46:51, 1:46:56]: occupational desi um denied me in the city of Stockbridge. [1:46:56, 1:47:04]: I have not applied to the state because I have to get in the um special use permit for in order for me to do that. [1:47:04, 1:47:08]: And all of this information was just brought to me. [1:47:09, 1:47:11]: Nobody ever told me that. [1:47:11, 1:47:14]: Окей і фі вона геть то да секунд левел. [1:47:15, 1:47:16]: Get this and get that. [1:47:17, 1:47:18]: Nobody ever said it. [1:47:19, 1:47:20]: So [1:47:20, 1:47:22]: I never applied for it. [1:47:22, 1:47:24]: I am waiting for an okay. [1:47:24, 1:47:28]: To go ahead because I spend a whole lot of money already. [1:47:29, 1:47:39]: And I need more money in order to put in the sprinkler, which is what was told to me. I need to put in the sprinkler and the um fire um [1:47:41, 1:48:00]: Sorry, I can't re remember the right word for it. It's okay. My second question is I know it says here that this the reason one of the reasons why was because there were reports of home improvement projects um that needed to be done since that process. Have the improvements been completed? [1:48:00, 1:48:03]: It have not been complete. I stopped on it because I was waiting. [1:48:03, 1:48:06]: Okay. I bought this house since in [1:48:06, 1:48:07]: April [1:48:07, 1:48:17]: And I've been paying mortgage on this house and I'm waiting and waiting and waiting and nobody says anything. When I come to them, that's when they told me that you were denied. [1:48:17, 1:48:37]: Okay. Um my next question is the site plan that you submitted, I I would assume you drew it. Um the site plan you submitted it has four bedrooms. So I I know you said there were six bedrooms, but looking at this the site plan from your s from you that you submitted with your application, it's clearly four bedrooms. [1:48:37, 1:48:53]: But I mean I see six beds but it's four bedrooms. Downstairs there is a basement, a full basement, which is where I'm residing. And upstairs is where I do business upstairs. Okay, see um four bedrooms, downstairs has two bedrooms. [1:48:53, 1:49:13]: Okay, see we would wanted see, I know you were saying six, but we would have wanted to see that in order to be on your side and say there is six bedrooms. You get what I'm saying? Um my last question is well you answered that you said you are staying at the home and I see multiple requirements that were missing that you needed to do from the city's perspective. Um but I'll yield to any more questions. [1:49:15, 1:49:25]: Go ahead, Mr. Mm. Thank you, Mr. Chairman. So ma'am, you sound like you're very passionate about what you do. I dream so and I all I ask is a chance to continue. [1:49:26, 1:49:44]: And I would say that you're obviously doing all you can to set up this business, but I do have some concerns, and it's been stated by some of the others. And I just want to clarify on page nine, item three, the applicant has no certifications or permits to operate in this capacity. You stated that you do have certificates. And these these have been presented to the city. [1:49:44, 1:49:50]: They have never asked me, never asked me as far as I have gotten. [1:49:50, 1:50:05]: Nobody ever asked for certifications or any of that matter. If they did, I would preside it because I do have a personal care home. And right now they I'm resigning with them because I was working, I left my job to see. [1:50:05, 1:50:10]: Over my own business and see what I'm doing to make sure that those people get the proper care that they need. [1:50:12, 1:50:32]: I I the reason I ask is because we're at this point where we're deciding as a commission whether or not to to bring li to recommend this to go to council again. Yet there's still a lot of open ended questions here. Okay. Um about your certifications, be it state, your own certifications and [1:50:32, 1:50:40]: And that's obviously has me concerned why those would not have been addressed already at this point. So the home certification, sir? [1:50:42, 1:50:43]: Which is um [1:50:45, 1:50:46]: May I ask? [1:50:48, 1:50:58]: Well, I'm I'm not up with the planning commission, but I would think that in the process of requesting that this go forward and proposing to the city [1:50:59, 1:51:17]: um this plan that uh uh all of your own qualifications, et cetera, would have been provided to the city, that this is what I want to do, and that I would have thought that at some point the city would have asked. And by every indication here, the city's making very bold statements that you don't have these things. [1:51:17, 1:51:21]: I don't have it for the city of Stockbridge for the house that I am [1:51:21, 1:51:23]: trying to get into. [1:51:23, 1:51:26]: to move my business into. I don't have it as yet. [1:51:27, 1:51:30]: Биказ і цін с дан а степ атай. [1:51:30, 1:51:37]: And instead of it going from the first stage to the second stage, they have me doing it from the last stage to the [1:51:38, 1:51:40]: So right now it is even conflicting. [1:51:42, 1:51:51]: To get it together, because I've always started from page one to page twenty-one, but now I have to start from twenty-one to one. [1:51:52, 1:52:08]: Okay. I I I don't want to refute your your qualifications or your certifications. I was just going strictly about what's before you. Well um I'm just letting you know I am gonna apply for the for the business license um for from the state for the city of um Stockbridge. [1:52:08, 1:52:26]: I am going to do everything that I have to do. I have um applied for some more funds to put in the sprinklers and to finish up the rest of the work to bring it up to date to as to what the code is asking and for me to um put in the application for this um for the state license. Okay. [1:52:26, 1:52:30]: Thank you. But before we didn't have to do that at first. [1:52:30, 1:52:43]: That was not the plan. That is thing you do after when you require most people. When you look for this um license, afterwards you have your client two or three. They will require you two or three certain um area or cities that you're in. [1:52:44, 1:52:45]: Um inst [1:52:46, 1:52:47]: Claydon County. [1:52:48, 1:52:50]: They allow you to have three. [1:52:51, 1:52:52]: Or four. [1:52:53, 1:52:56]: And then you will apply for special use permit. [1:52:57, 1:52:58]: You put in the sprinkler. [1:52:59, 1:53:15]: Then you have to reapply for another license to up u upgrade what you have, that you have more people to accommodate the six people or how many people they allow you, you have to apply for another license. And this is how I'd set to do what I was doing. [1:53:16, 1:53:26]: But because occupational is standing in my way, saying that they don't allow it in the city of Stockbridge, but the code is clearly saying that they are still they were doing it. [1:53:27, 1:53:36]: I got caught up right there. So I was confused because I even asked them if they didn't want me to have the business there. They could go ahead and [1:53:36, 1:53:38]: Just purchase the house or [1:53:38, 1:53:43]: Get the house and I will get something else because I said I wouldn't go and purchase a [1:53:43, 1:53:46]: Three hundred and twenty something thousand dollar house. [1:53:46, 1:53:48]: paying mortgages and um [1:53:49, 1:53:55]: Knowing that they don't want the business there. I wouldn't buy this house. I love the location. [1:53:55, 1:54:15]: Mr. John, l may well you finish. No, I I I'm finished, Mr. John. Okay. Thank you, Chair. Thank you. May I uh ask a question, please. Are you willing to defer this and go back with the staff and iron out those difficulties that we were facing? Because I in my opinion, we're not prepared to [1:54:15, 1:54:28]: to do a vote on this. I don't think we're ready. I don't think enough has taken place between you and the t staff to iron out all the requirements. [1:54:28, 1:54:45]: And I think in fairness to you, it would be appropriate if we defer this and allow you the opportunity to to get all those things addressed that needs to be addressed and then come back to us once that's done and then we can make a decision. [1:54:46, 1:54:53]: Okay, well I can I can do that. Would you agree to that? I would agree to that. I just wanna make sure that [1:54:56, 1:54:57]: Мі дуєн вот авту. [1:54:58, 1:54:59]: Then [1:54:59, 1:55:02]: You can say well, okay, you reach the requirement. [1:55:03, 1:55:11]: Has the license to continue doing because everything I have to do, it costs me a lot of money. I understand that, but please understand that. [1:55:14, 1:55:16]: We can't get ahead of staff. [1:55:16, 1:55:19]: And I understand that. Absolutely. [1:55:20, 1:55:27]: Whatever needs to take place needs to take place before it comes to us. [1:55:28, 1:55:30]: In order for us to make a fair decision. [1:55:31, 1:55:31]: Up or down. [1:55:33, 1:55:35]: Right now there's just too many things. [1:55:36, 1:55:36]: Yeah. [1:55:38, 1:55:56]: Dangling. If I'm Yeah, there are things handing. So i if if you would agree to defer it and meet with staff and get all those things worked out. Mm-hmm. Uh because uh we'd be here all night. [1:55:57, 1:56:01]: Back and forth about what ought to be and what should be, what shouldn't be. [1:56:02, 1:56:05]: And and we won't get and at the end of the night we still won't resolve anything. [1:56:06, 1:56:06]: Right. [1:56:06, 1:56:09]: So I'm gonna suggest to you [1:56:12, 1:56:14]: If you would agree to defer it. [1:56:15, 1:56:23]: Go back, get with staff and work those things out. And then when it's appropriate, they'll bring it back to us for a decision. [1:56:24, 1:56:25]: Is that okay with you? [1:56:26, 1:56:34]: Yes, it is okay with me to go back and do things however they want me to do it. [1:56:35, 1:56:36]: Now [1:56:36, 1:56:37]: There is one thing. [1:56:38, 1:56:40]: I don't have control over [1:56:41, 1:56:42]: How long? [1:56:42, 1:56:45]: The state will take to give me a license for this. [1:56:46, 1:56:48]: I don't have control over it. I can [1:56:49, 1:56:51]: Get everything in order, put in the application. [1:56:52, 1:56:55]: They decide how long they take to give it to you. [1:56:56, 1:56:58]: It vary as to how ma how many [1:56:58, 1:56:59]: The applications they have. [1:57:00, 1:57:07]: And it may take from one to two months before I can get that we have no influence in that regard. [1:57:08, 1:57:10]: Well what happens with the state in you? [1:57:13, 1:57:15]: That's not an area that we can weigh in on. [1:57:17, 1:57:26]: Okay. So I'm just suggesting that you go back and take the necessary steps that needs to be taken care of and need to be satisfied. [1:57:27, 1:57:28]: And then bring it back. [1:57:29, 1:57:33]: In order for us to be able to make an intelligent decision. [1:57:33, 1:57:34]: Okay. [1:57:35, 1:57:46]: Okay. Fair enough. Is that fair enough? It's fair enough. Thank you. I will thank you very much. Okay then thank you, sir. Mm-hmm. Chair, do we need a motion for that? I do. Would you? [1:57:46, 1:57:55]: Yeah, I don't mind. Um I make a motion to defer the special use permit case S B dash twenty twenty four dash oh three until staff brings it back before the body. [1:57:56, 1:58:15]: And I second it, Harold. It's been moved by Mr. Williams and second by Mr. Thibodeau that uh S P K twenty twenty four dash zero three be deferred to sometime in the future until the applicant has met with [1:58:24, 1:58:25]: Anyway. [1:58:31, 1:58:32]: Okay. [1:58:35, 1:58:45]: Did you hear that, Mr. Lee? Would you restate your motion, please? Yes, sir, Chair. Um just to clarify real quick, I know some people had comments. Do we uh would we have to defer those comments to the meeting? [1:58:46, 1:58:51]: Seventeen odd. Okay. Alrighty. Uh Miss John, you prefer one month or two months? [1:58:51, 1:58:56]: I'll rather two months the longest I can get because the state said the state [1:58:57, 1:58:58]: I got you. [1:58:58, 1:59:10]: Chair, I make a motion that we defer uh special c use permit case SB dash twenty twenty four dash oh three to November, the meeting in November, which will be November twenty first. [1:59:12, 1:59:20]: And I second it, Harold. It's been moved by Mr. Williams that we defer the s SPK s twenty twenty four-zero three. [1:59:20, 1:59:23]: Until the November Planning Commission meeting. [1:59:24, 1:59:29]: It was second by mister Tibodeau. All in favour, let it be known by the sound of I. [1:59:29, 1:59:31]: Ah okay. In the opposed. [1:59:32, 1:59:39]: It's unanimous. If this case is deferred until November. Thank you very much. Thank you, Ms. John. [1:59:46, 1:59:49]: Any comments from staff, Mr. Anderson. [1:59:50, 2:00:08]: Yes, we will have um at the next planning commission we will have a training session for you guys. Um it will last maybe an hour, uh'cause we'll have a light agenda next month. So be prepared for that. Uh we'll send out the the materials and if the materials that you need in advance. Thank you. [2:00:10, 2:00:15]: Anything else? Okay, thank you. Any comments from the commission? [2:00:20, 2:00:21]: That's quiet. [2:00:23, 2:00:24]: All right. [2:00:26, 2:00:28]: If there are no other comments, I need a motion to adjourn. [2:00:29, 2:00:32]: Should I rather make a motion to adjourn? [2:00:40, 2:00:48]: The the last item um the floor wasn't open for public comments and they had um submitted a speaker card. [2:00:50, 2:00:53]: You mean the item we got in the liquor store? [2:00:55, 2:00:58]: The personal care home. Oh [2:01:00, 2:01:01]: We we we deferred it. [2:01:15, 2:01:21]: Does that motion should be opened to the public? I understand that, but I I'm just curious as to why would we do that when [2:01:23, 2:01:24]: It's a [2:01:25, 2:01:45]: Just because they're here. Okay, very good. Thank you. Then we and we will open the public hearing on case SP twenty twenty-four-three for public comment. If you would uh fill out a form if you haven't already done so. Approach the podium and say what you have to say. [2:01:45, 2:01:47]: Say, give us your name and address, please. [2:01:54, 2:02:09]: My name's Robert Bost. Uh I I reside at 254 Shields Road, two houses down. I've been in that house for thirty-five years. Uh I'm I'm all for personal assistance and personal care. [2:02:10, 2:02:27]: But but to change the zoning on on this, I I'm totally against it. My two neighbors in between at two sixty and two fifty are against it also. And and why do you want to defer it? Just say no. Thank you. [2:02:28, 2:02:31]: Thank you, sir. Anyone else? [2:02:39, 2:02:45]: My name's Robert Schule. I live at two fifty three Shields Road, which is directly across the street from this property. [2:02:46, 2:02:52]: I'm gonna have headlights f shining in my windows at night with all this traffic coming in and out. Um [2:02:54, 2:03:14]: She's elderly people she's taken care of. I was taken care of a friend of mine that has dementia. He gets up and wanders. Are these people being wandering out of the house? Shields Road is a real busy road. We can't get the police, we can't get the city to help slow the traffic down. I'm afraid somebody's gonna get hit as a my [2:03:14, 2:03:27]: My other thing. It's a residential area. I have five point four seven acres across the street. Who's gonna buy my property knowing that there's a business across the street when I do go to sell? Um [2:03:28, 2:03:40]: What about our property values? How's that gonna affect our property values? Um I don't know if this business is gonna have to be ADA uh accessible. [2:03:41, 2:03:46]: Are the doors in the house thirty six inches for wheelchairs? I don't know that. [2:03:48, 2:04:08]: At 931 Rockwari Road, there's a facility that's vacant. That was uh assistant living. I understand she's passionate for this and everything else. We have an empty building and a commercial area that's available to do what she wants to do. I don't understand, I mean, financially dynamically. [2:04:08, 2:04:19]: Whatever, but I don't see why we would have to take a residential area and turn it into something else. Um that's all I have. [2:04:19, 2:04:20]: Thank you, sir. [2:04:20, 2:04:21]: Thank you. [2:04:22, 2:04:23]: Anyone else? [2:04:26, 2:04:30]: Public hearing for case sp twenty twenty-four- zero three is now closed. [2:04:42, 2:04:43]: Okay. [2:04:44, 2:04:48]: Thank you, Madam Attorney. I need a motion from the commission. [2:04:48, 2:04:58]: Chair. Yes, sir. I make a motion that we defer special use permit case SP dash twenty twenty four dash oh three to the November twenty first uh planning commission meeting. [2:04:59, 2:05:04]: And I second it, Harold. Been moved by Mr. Williams, a second by Mr. Thibodeau. [2:05:05, 2:05:20]: That we defer SP twenty twenty-four-zero three until the november twenty-first meeting. All in favor? Let it be known by the sound of aye. Aye. Any opposed? The ayes have it. It's a unanimous vote. [2:05:20, 2:05:23]: So be it. This case is deferred. [2:05:27, 2:05:31]: Hey now, any comments from the board? [2:05:32, 2:05:34]: In the war comments from the war. [2:05:37, 2:05:40]: Hearing none, I need a motion to adjourn. [2:05:41, 2:05:55]: Mr. Chairman, I make the motion to adjourn. And I second it, Harold. It's moved by Mr. Mitten, seconded by Mr. Thibodeau, that we adjourn this meeting. All in favor? Aye. Aye. Any opposed? [2:05:56, 2:06:02]: The eyes have it, the meeting is adjourned. Thank you. Thanks for coming, everyone.
