[0:19:49, 0:19:52]: Okay, well we'll go through the process here. [0:19:53, 0:20:01]: Georgia Rees Day, uh in recognition of that, uh whereas literacy is not just an education issue, but an economic workforce and quality of life issue. [0:20:01, 0:20:04]: is also a predictor of the future educational achievement. [0:20:05, 0:20:06]: Economic status and long [0:20:07, 0:20:08]: Lifelong health and well being. [0:20:09, 0:20:15]: In two thousand twenty-three, sixty one percent of Georgia uh ris raising excuse me, rising fourth graders did not read proficiently. [0:20:15, 0:20:25]: And research shows that children who are proficient readers by the end of the third grade are four times more likely to graduate from high school than their peers who are not uh reading on grade level. [0:20:26, 0:20:36]: Whereas the General Assembly I recognize the importance of literacy skills with the passage of two bills in twenty twenty three, SP two hundred eleven, that created the Georgia Council of Lit on Literacy. [0:20:36, 0:20:42]: And the HP five thirty eight that requires comprehensive education reforms for reading instruction in the science of reading. [0:20:42, 0:20:59]: And whereas understanding of the collaborative efforts of strategic partnership must be undertaken to effectively address literacy issues, the Georgia Municipal Association, GMA, is a non-profit, it's nonprofit organization, Georgia City Solutions, members of the general uh of the general Georgia General Assembly. [0:20:59, 0:21:01]: In a football champion now turn. [0:21:02, 0:21:10]: Children's author Malcolm Mitchell partnered with the Georgia Council of Literacy to launch Georgia Reads in the 2024 GMA annual convention. [0:21:10, 0:21:30]: And whereas community involvement is essential to literacy and improvements in a Georgia and Georgia Reeds, with uh will which will include recognizing 10 community partnerships that have uh increased literacy in the past three to five years at Georgia Reeds communities. Whereas September 30, 2024 marks a date uh when our Georgians are encouraged to create awareness of [0:21:30, 0:21:44]: about the importance of reading and encouragement of community partnerships to promote future literacy improvements. Whereas together we improve Georgia's economic viability one book at a time. Now therefore I Anthony S. Ford, Biper Authority Vested Me. [0:21:44, 0:21:56]: As the mayor of the city of Stockbridge, Georgia, and on behalf of City Council members out in Alexander, Ilana, Barber, John, Blount, Kisha Gann, and Fonsel Thomas, we pro hereby proclaim September 30, 2024, a Georgia Reeves Day in the great city of Stockbridge, Georgia. [0:21:57, 0:22:10]: A witness thereof, I have here unto set my hand in the Great Seal City, Stockbridge, Georgia, the ninth day of September, year of our Lord, 2024, and assigned a proclamation along with our clerk for Nessa Holiday. And here's ladies and gentlemen. [0:22:11, 0:22:12]: Uh just uh [0:22:13, 0:22:19]: I guess we might have to take a picture of this as well. Reading this one no more. Yes, correct. [0:22:19, 0:22:32]: Any educators with us or any educators or retired teachers? Oh okay. I'm sorry. Yeah, but I'm appreciating you back. You gotta think we can change. [0:22:39, 0:22:44]: Thank you. I I'm sorry. [0:22:46, 0:22:50]: We uh we have that on the first thing. Okay, okay. [0:22:52, 0:22:52]: Oh [0:22:55, 0:23:10]: I don't know where it is. Okay. Okay, I'm like that. I I I haven't done that yet at this point. So uh that's it, come on up forward, please. [0:23:17, 0:23:31]: How are you doing? Yeah, yes, come on over here please. So this is uh so otherwise, ladies and gentlemen, I guess in a sense. You can touch the mic here. [0:23:32, 0:23:52]: We have a award for our water department, is that right? Yes. Okay, so go right ahead, please. All right. My name is Pam Burnett, and I'm the executive director of the Georgia Association of Water Professionals. We're a state association, professional association. We've been around for 92 years working with all of the water systems, which includes waste. [0:23:52, 0:24:00]: Water, water supply, stormwater, any form of water in Georgia. We uh we we help with the education training. [0:24:00, 0:24:20]: And recognition of water professionals. So I'm very proud of this award. This we have a program called the Gold Awards for those systems that achieve perfect compliance with their federal and state permits. And these are very complicated facilities: water plants, wastewater plants. [0:24:20, 0:24:40]: Are very complicated facilities. They require a lot of training, special skills, but probably above all of that, real commitment and diligence to doing the work of producing clean water, safe water that's delivered to you every time you turn on the faucet. [0:24:40, 0:24:53]: And every time you flush the commode, it goes away and it's treated and restored and returned to the environment safely and in a clean way so somebody else can use it. [0:24:53, 0:25:13]: So, in our awards program, the reason we recognize uh perfect compliance, and that's what this award is about, is perfect compliance with the state laws and federal laws. And I'm telling you that these plants are so complicated, it is not easy to achieve perfect compliance because perfect compliance means even submitting [0:25:13, 0:25:22]: your reports on time. You could you could get a number transpose, anything that'll n that'll knock you out of [0:25:22, 0:25:40]: of of compliance, it could be just something very simple. It could be the post office, not getting something on time. So it's not easy to achieve. It requires all of the things that I said before, just tremendous attention to the details and the um product. [0:25:40, 0:25:46]: So in Stockbridge this year, we recognized the um the water plant. [0:25:48, 0:25:51]: Received oops, I'm sorry, this is my platinum award. The gold award. [0:25:53, 0:26:13]: I'm I'm backwards on this. The wastewater plant received the Gold Award this year. And again, this is a full year of perfect compliance. And thank you for doing this. This is this is great for the environment. Absolutely great for the environment. Okay, so here's another piece of it. [0:26:13, 0:26:28]: If you receive gold award status, which is again perfect compliance, but if you do that for six years in a row, after the fifth year, you're eligible for our platinum awards. So think about that. One thing can knock you back. [0:26:29, 0:26:32]: And you have to start over with the gold awards. Well, you've got [0:26:32, 0:26:33]: Water plant. [0:26:33, 0:26:34]: That achieved [0:26:35, 0:26:48]: I'm sorry. Yes, this is the water system that that received the platinum award. And the f the the water plant has not received a platinum award in fifteen years. So this is an amazing accomplishment. [0:26:51, 0:26:55]: And and it's it has everything to do with the leadership of the department. [0:26:56, 0:27:00]: Dashes is um and your team have done an incredible job. [0:27:00, 0:27:02]: But I have to thank the лідерs. [0:27:02, 0:27:08]: Stockbridge as well because you are a key to providing the resources and the support of the team. [0:27:09, 0:27:19]: It's not an easy job that they do, and they have to do it every day, twenty four hours a day, so that you can flush your toilet and you can drink water. So thank you so much. Really proud of you. [0:27:20, 0:27:28]: Thank you. So anybody else from your department is here? No. Okay, so why don't we why don't you take these so we gotta take some well first of all you got any comments or no? [0:27:30, 0:27:50]: I'd just like to say congratulations and thank you to our hard working team for all their efforts in ensuring that we remain compliant with our permit. Our sewer superintendent, Mr. Kevin Miller, was planning to be here, but his mom passed on Saturday, so just keep him and his family in your prayers. Thank you. All right. So once you once you take this sir, we will take this picture. [0:27:50, 0:27:59]: These are yours, I don't need to hold come in sir. These are yours. These are yours. I don't need to hold these. These are yours. All right? All right. So uh let's take some pictures here. Come on in, come on in. [0:28:01, 0:28:05]: Well I think it's all [0:28:14, 0:28:20]: Yeah. [0:28:22, 0:28:30]: And I have one more proclamation, ladies and gentlemen, before we uh end this particular ceremonial part of our program. This is National Hispanic Heritage Month. [0:28:31, 0:28:36]: Is anybody here to receive this uh award? Proclamation. Okay. [0:28:36, 0:28:53]: Whereas each year American observes National Hispanic Heritage Month annually from September fifteenth to october fifteenth by celebrating the contribution of the influence of Hispanic Americans to the history, culture and achievements of the United States of America, citizens whose ancestors came from Spain, Mexico, Caribbean, Central and South America. [0:28:54, 0:29:09]: Whereas the observation started in uh observation observation, that was right, started in nineteen sixty eight as a uh Hispanic Heritage Week under President Lyndon Johnson and was expanded to President Ronald Reagan in nineteen eighty eight to cover a thirty day period starting September fifteenth and ending october fifteenth. [0:29:10, 0:29:13]: It was enacted into law on august seventeenth, nineteen eighty eight. [0:29:14, 0:29:34]: Under approved public law 100-402. And whereas the day of September 15 is significant because it is the anniversary of independence of Latin American countries: Costa Rica, El Salvador, Guala Mama, Honduras, and Nicaragua. In addition, Mexico and Chile celebrate their independence days on September 16th and September 18th, respectively. Also, Columbus Day. [0:29:34, 0:29:39]: or De Lorato Day, which is October twelfth falls within the thirty day period. [0:29:39, 0:29:54]: Whereas this year's theme, everything is possible, everything is possible, Latinos, great economic growth, innovation, innovation, excuse me, and ca competitiveness, a stronger uh middle class and set to values centered on family and hard work and opposition opposition. [0:29:54, 0:30:14]: And whereas the city of Stockbridge uh continues to support the Hispanic and Latin community and encourage everyone to celebrate its the Hispanic and Latin culture in and around the Stockbridge community and surrounding area. Now, therefore, I Anthony Splor by virtual authority best than me as the mayor of the city of Stockbridge, Georgia. And on behalf of City Council members Elton, Alexander Londa, Barber Cowberry, and Lisa. And I signed the proclamation along with our clerk Vanessa Holiday. Okay. [0:30:34, 0:30:44]: So let's uh picture this. Yeah, no no no. [0:30:51, 0:31:05]: Thank you very much. Okay, appreciate it. All right, so uh we have uh almost six o'clock here, ladies and gentlemen. Is it gonna be it for now for this? I guess you need to collect all these items here. Something else to have? [0:31:05, 0:31:17]: I don't know, is there a Miss Scott here? Mary Scott? [0:31:17, 0:31:20]: Okay, there's a new sky. Okay. [0:31:21, 0:31:22]: Speed. [0:34:40, 0:34:41]: Okay, good, good. [0:38:49, 0:38:52]: On the adjustment I will uh [0:41:04, 0:41:05]: You could take this though. I pledge allegiance to the flag of the United States and to the Republic for which it stands one nation under God independent liberty and justice war. [0:42:19, 0:42:21]: Madam Clerk, roll call, please. [0:42:24, 0:42:42]: Good evening everyone. Mayor Ford. Present. Mayor Pro Temberry. Present. Councilmember Alexander. Present. Council Member Barber. Present. Council Member Gantt. Present. Council Member Thomas. Present. Mayor Ford, you have a quarrel. Thank you, Madam Clerk. Appreciate that. Mr Berry, Mayor Pro Temberry, please. [0:42:42, 0:42:52]: Yes. Um mayor I'd like to make a motion to amend the agenda to remove item number five, noting that the requested amendment is already in compliance with the city's comprehensive plan. [0:42:53, 0:42:58]: There are second to that second. I second. Ms. Okay, I gave it to Mr. Alexander. All in favor, please indicate. [0:42:59, 0:43:01]: Okay, it comes off. Go ahead, Mr. Berry, please. [0:43:01, 0:43:13]: And also I'd like to make another motion to remove items number seven, number eight, number nine, and ten from the agenda due to the applicant's request for deferral to be heard at the October fourteenth meeting. [0:43:13, 0:43:25]: To a second that motion. I said that okay Miss uh Ms. Gamf uh second hand on favor please indicate unanimous decision. Okay, appreciate that. Mayor Ford, yeah. I'd like to make a request to amend the agenda. [0:43:26, 0:43:46]: Well st stand stand by one second, please. Stand by. Ms. Uh Mr. Alexander, go ahead, please. Yeah, I just wanted to make a comment if we could. Uh to make sure that everybody is clear. Uh the item on Hudson Bridge Road was removed tonight. Uh it was removed tonight to continue to work on the plan. Uh the developer has uh [0:43:46, 0:44:06]: is working on the plan to refine it to come into a qu to see what Lakerbeard put together some better conditions. What will be described and uh come out of that process uh over here, right here by the wall wa the um Walmart area in Taco Bell. [0:44:05, 0:44:25]: Is a gated community, which which has been agreed upon already, with uh very nice town homes that'll be developed. Uh the price point in those pounds home projected to be three fifty to four hundred thousand dollars. Um we have a fifty-four million dollar road project that will begin uh in that area. So there's a [0:44:25, 0:44:45]: A lot of moving parts to see how this particular um development will move forward in its final iteration. It was indicated that uh we made this deferral for some reason, other than that. There was no other reason other than that uh the uh [0:44:45, 0:45:05]: uh product that we received. Uh we asked for upgraded product and we the upgraded product is being worked into it so that uh it will fit into alignment and actually exceed the value of the current homes uh in the area. So what will happen is that uh will be heard on October the fourteenth [0:45:05, 0:45:25]: The public will be given an opportunity to speak on it and to weigh in on the final iteration of what the plan will look like and to just understand that, you know, if you need the information, come to the city. We got the information. Okay, there's a lot of misinformation out there. [0:45:25, 0:45:45]: About all the product, whatever project that we have, you can come to the city to the planning and zoning development and request it. You know, there was an iteration or a picture shared of what the development was looking like. The final development won't look anything like the picture that was shared at all. So if you want to understand what it looks like, [0:45:45, 0:46:05]: Like, come to the city, we will be able to provide you with the factual information so there's no misunderstandings on where we stand in terms of this particular project. In addition to that, I will close by saying there was a number of one-car garages that were in the particular development request. [0:46:05, 0:46:25]: Those one-car garages are being removed. As a result of the one-car garages being removed, it will reduce some of the units that are available. So everything will have a two-car garage in this particular development. The council will have to decide on what needs to be done, but certainly the iteration of the current final plan. [0:46:25, 0:46:40]: is being worked on. Thank you. Thank you, sir. Ms. Barber Glade, please. Yes. I'd like to request to amend the agenda for two items. One, um, for mayor's consideration to reactivate the finance committee. [0:46:42, 0:46:45]: Should I do both of these separately? Yes, you should. Okay. [0:46:46, 0:46:48]: I'd like for the council to consider. [0:46:48, 0:46:51]: For the mayor who has the responsibility [0:46:51, 0:46:52]: Um or [0:46:52, 0:46:55]: He has the where it all to be able to reactivate. [0:46:56, 0:46:57]: The finance committee. [0:46:58, 0:46:59]: Is there a second to that motion? [0:47:02, 0:47:03]: Is there a second to the motion? [0:47:04, 0:47:14]: The motion fails. Go on with your next motion, please. The next motion, um, I'd like to add to the agenda a council discussion to define a policy or procedure. [0:47:14, 0:47:18]: to dispose of city owned real estate properties. [0:47:19, 0:47:21]: Okay, is there a second to that motion? [0:47:22, 0:47:24]: Is there a second to that motion? [0:47:25, 0:47:32]: Motion fails. I need in my a motion to to adopt the entire agenda, please. Come here. Yeah, yes sir, go ahead please. [0:47:36, 0:47:37]: Yes sir. [0:47:38, 0:47:41]: I wan I wanna state in the record that [0:47:41, 0:47:43]: When it comes to [0:47:43, 0:47:44]: Committees. [0:47:46, 0:47:53]: that the mayor has the sole authority to uh appoint um [0:47:54, 0:47:56]: The chair of these committees [0:47:57, 0:47:59]: And that the council [0:47:59, 0:48:02]: Do not have [0:48:02, 0:48:04]: in authority to [0:48:04, 0:48:07]: to to to set those and so [0:48:08, 0:48:10]: I would hope that [0:48:10, 0:48:12]: U and [0:48:12, 0:48:16]: Councilwoman Barber would just have that discussion on your own. [0:48:16, 0:48:30]: And uh make sure that that process is is adhered to. Thank you. Mayor Ford, if I may, add a comment in response to Councilman um Thomas. Go ahead, please. Okay. [0:48:30, 0:48:38]: So I don't know the background. I don't know the background as to why the original finance committee was deactivated. [0:48:38, 0:48:44]: But it's been some time ago, I guess ten plus years ago, Councilwoman Gantt would know. [0:48:44, 0:48:51]: Um or maybe the city clerk can find the background information on why it was deactivated. [0:48:51, 0:48:53]: But our city has grown. [0:48:54, 0:48:56]: A lot of changes have been made here. [0:48:56, 0:49:00]: Ви ніде фананс борд файнс коміті. [0:49:01, 0:49:05]: That is what my original request was. [0:49:05, 0:49:08]: My original request was for [0:49:09, 0:49:10]: Us to reactivate [0:49:11, 0:49:16]: The finance коміті, if we want to name it something else, a finance board. [0:49:16, 0:49:17]: So be it. [0:49:18, 0:49:27]: I understand based on the charter that the mayor is the only one who has the powers to activate a committee. [0:49:28, 0:49:30]: However, all of the other boards [0:49:32, 0:49:35]: The council they have council liaisons. [0:49:35, 0:49:36]: Not a chair. [0:49:37, 0:49:39]: That's my understanding. [0:49:40, 0:49:42]: I want us to have a discussion. [0:49:42, 0:49:43]: Regarding [0:49:44, 0:49:46]: Reactivating. [0:49:46, 0:49:47]: The finance committee. [0:49:48, 0:49:50]: If we need to change [0:49:50, 0:49:54]: The position from chair to a council we aise on, so be it. [0:49:56, 0:50:00]: That is why I wanted to have a discussion regarding [0:50:00, 0:50:05]: Реактивати Фінанс комітеті, Фінанс Борд. [0:50:05, 0:50:11]: Whatever you want to call it. I also suggested that I don't I would mind being [0:50:11, 0:50:13]: The council liaison. [0:50:13, 0:50:17]: Now the city clerk corrected me and she said, Well, with the finance committee [0:50:17, 0:50:18]: That [0:50:18, 0:50:22]: committee has a chair, not a council liaison. [0:50:23, 0:50:26]: It's the only committee that has. [0:50:26, 0:50:27]: A t here. [0:50:28, 0:50:29]: So [0:50:30, 0:50:32]: I wanted us to have this discussion. [0:50:32, 0:50:33]: So [0:50:33, 0:50:35]: That we all can get the background. [0:50:36, 0:50:44]: On what happened with the original finance committee while we no no longer have it. I am the only member of the governing body who's not serving. [0:50:45, 0:50:46]: On any board. [0:50:47, 0:50:48]: Or committee. [0:50:49, 0:50:49]: So [0:50:50, 0:50:51]: That was an opportunity. [0:50:53, 0:50:53]: Tesla. [0:50:54, 0:51:06]: All right. As as you well know, Councilwoman Barber and an attorney as well as the uh clerk received a memo from me about that outlining the trial responsibilities of the mayor. [0:51:06, 0:51:20]: And all committee. Committees and boards are two different things. The committee the committee aspect, committee and committee chairman of of any officers of the city council shall be appointed by the mayor and shall serve in the pleasure of the mayor. The mayor shall have the power and appoint new members of any committee at any time. [0:51:20, 0:51:33]: Also, my memo, I mentioned the finance department will soon gain additional uh support to handle the daily uh responsibilities and full confidence. I have full confidence in city manager who has operational supervision and entire to ensure the successful management of the finance department. [0:51:33, 0:51:36]: What it will work well without a committee involvement. [0:51:36, 0:51:51]: I had mentioned that to you. Now what it is is that the boards, the actual boards, there are four boards, four council members are liaisons to those boards. Those boards are are discussed and determined by the council themselves. Only vote unless there's a tie. [0:51:51, 0:52:07]: All right, unless uh some other board member or uh uh a board member's term expires and that individual is willing to give up that responsibility or the council decides to switch it, then that's the council desire of those boards. We need to move on with the meeting this evening. Okay. [0:52:07, 0:52:13]: If I may, and this will be my last comment, I'm sorry. I surely hope so. Okay. So as I said [0:52:13, 0:52:15]: I understand that [0:52:15, 0:52:16]: Committees [0:52:16, 0:52:17]: The mayor. [0:52:17, 0:52:20]: has the responsibility of appointing a chair. [0:52:21, 0:52:22]: It doesn't have to be a committee. [0:52:23, 0:52:24]: It could be a board. [0:52:24, 0:52:27]: Just as we have the downtown development authority board. [0:52:28, 0:52:36]: Just as we have the Citywide Development Authority Board, just as we have the Main Street Board, just as we have the Youth Council Board. [0:52:37, 0:52:40]: All of those boards have council liaison. [0:52:40, 0:52:43]: Just so happened, the finance committee. [0:52:43, 0:52:45]: requires a chair. [0:52:45, 0:52:46]: Well [0:52:46, 0:52:49]: We don't necessarily have to call it a commitті. [0:52:49, 0:52:51]: It could be a finance board. [0:52:52, 0:52:54]: Just like the rest of [0:52:54, 0:52:57]: the committees and well boards that we have. [0:52:58, 0:53:00]: This would be the third. [0:53:01, 0:53:04]: Third time the mayor has rejected. [0:53:04, 0:53:08]: My request to serve on any board or committee. [0:53:08, 0:53:10]: I don't know why. [0:53:10, 0:53:11]: My councilmates [0:53:12, 0:53:17]: And the mayor do not want me to serve on any board or committee. [0:53:17, 0:53:18]: You should know why. [0:53:19, 0:53:23]: You should know why. If you've been watching these meetings, you ought to know why. [0:53:23, 0:53:29]: I am all about transparency in the way we govern and the way we do business. [0:53:30, 0:53:31]: So I'll um [0:53:32, 0:53:39]: hopefully be able to bring this back after I speak with my councilmates and come to a resolution. Thank you, Mayor. [0:53:40, 0:53:46]: You're welcome. I need now need a motion to adopt the rest of the agenda, please. Mayor Ford, I'll move. Is there a second? [0:53:46, 0:53:48]: Mayor Ford. [0:53:48, 0:54:05]: May Mr. How's I second that. All in favor, please indicate. Mayor Ford, I have a comment before we vote, because these minutes do not reflect the statements that I made. In fact, I've sent amendments to the clerk to make to all of [0:54:06, 0:54:26]: The minutes. What excuse me, what minutes you're referring to? All four of the minutes. August twelfth, August twenty seventh. Or a point of order. August twenty four. Stand by. August twenty sixth. To make revisions to those minutes based on the statements and comments. [0:54:26, 0:54:46]: that I made during those meetings. What point order w the point order, listen, we're adopting the agenda. The adoption of the minutes comes after adopting the agenda. Yes. Now so I need a motion to adopt the agenda please. What I've asked is I want to make an appointment. You're out of line, stand by. I need the motion to adopt the agenda. You've had a first, you've had a motion and a second. Okay. [0:54:46, 0:54:47]: All in favor, please indicate. [0:54:48, 0:54:55]: Thank you. Okay, therefore. Now I need a motion. Well, we got the no now in the motion, adoption of the minutes. Stand by. [0:54:56, 0:55:16]: Minutes uh for adoption are August twelfth council meeting minutes, August 27th, the council work session minutes, August 21st, the Council retreat minutes, twenty august twenty-second, the council retreat minutes, and August 23rd, the council retreat minutes. All right. Mayor Ford. Yes, ma'am. I'd like to approve the minutes. [0:55:16, 0:55:20]: with amendments that have been sent citiz to the city clerk. [0:55:21, 0:55:32]: All right. Well, first of all, those amendments that have been sent to city clerk. I do not know whether or not those amendments have been sent to everybody else to for them to vote on at this point. I've never sent revisions to the entire council. [0:55:32, 0:55:37]: Норгас каунсел сен ревизион корекція мade. [0:55:37, 0:55:38]: To the minutes. [0:55:39, 0:55:42]: Ma'am Madam Clerk, you received some amendment some changes to the [0:55:43, 0:55:48]: And and um and where do you stand on that? I mean what's we don't I have no idea what that's about. [0:55:50, 0:55:54]: Not um a lot of change to the actual minutes, it was verbiage. [0:55:55, 0:55:57]: Verb is such as um [0:55:57, 0:56:00]: Not really changing the content of the minutes. [0:56:08, 0:56:23]: Well in in addition to I'll stand by please. Madam Clerk, anything else at this point? All right, go ahead please. In addition to the discussion that we had during the retreat regarding reactivating the finance committee. [0:56:23, 0:56:24]: When I first spoke [0:56:25, 0:56:26]: about the finance committee. [0:56:27, 0:56:29]: I said I wanted to be the council liaison. [0:56:30, 0:56:31]: It was a city clerk. [0:56:32, 0:56:35]: Who corrected or advised that [0:56:36, 0:56:39]: There is no council liaison on the finance коміті. [0:56:40, 0:56:41]: It would be a chair. [0:56:41, 0:56:43]: She also informed all of us. [0:56:43, 0:56:44]: That the mayor [0:56:45, 0:56:46]: Газ респонсабілі. [0:56:46, 0:56:50]: Of reactivating and appointing a chair. [0:56:50, 0:56:52]: That information [0:56:52, 0:56:54]: Is not included. [0:56:54, 0:57:01]: In the minutes. All that's in the minutes is me asking the mayor to appoint me [0:57:01, 0:57:04]: Ас на Чер о Фінанс Коміті. [0:57:04, 0:57:06]: Listen, I don't wanna play any games. [0:57:07, 0:57:09]: We've got a long agenda. [0:57:10, 0:57:11]: Let's go ahead. [0:57:11, 0:57:15]: I want to move to approve the meeting minutes. [0:57:16, 0:57:21]: With the amendments that have been sent to the city clerk. [0:57:21, 0:57:22]: All of them. [0:57:24, 0:57:26]: Uh Mayor. Yeah, go ahead, please. [0:57:26, 0:57:37]: I I'm sorry, but um Miss Holiday, I can't approve minutes that I don't see. Can you please read those amended changes that are being requested? [0:57:37, 0:57:42]: If and any time we do ask for something to be amended or corrected is usually [0:57:43, 0:57:43]: During the [0:57:44, 0:57:55]: after the work session or or after a meeting before the minutes have to be approved and they were all they would already be approved in these minutes. So it's not [0:57:55, 0:57:57]: like um [0:57:58, 0:57:59]: What's being stated? [0:57:59, 0:58:02]: We actually request if we see an error. [0:58:02, 0:58:05]: will actually ask that [0:58:05, 0:58:15]: that be corrected and then it would actually be printed here in the meeting minutes. But I can't vote on something that was emailed by another council member if we didn't see it. [0:58:17, 0:58:24]: Madam Clerk, could you read that please? Could those those particular changes? I'm I'm not able to read it. Stand by, let her listen to what she has to say. [0:58:25, 0:58:34]: Go ahead please. The the amendments were sent out after the minutes were sent out to council. [0:58:36, 0:58:55]: I I came back from Athens today. I have not had an opportunity and that was stated. But there is a precedence set by this council where and it's stated by the mayor at the previous meeting, any changes that need to be made, please submit that to the clerk. That has happened. [0:58:56, 0:58:58]: I can't count the number of times. [0:58:58, 0:59:00]: And it there is a precedent there. [0:59:01, 0:59:05]: So what you all decide to do, they you don't have to t approve the minutes today? [0:59:06, 0:59:15]: Ms. Barber's asking that they be approved with the amendments. That has been customary, but it's up to the council what you choose to do today. [0:59:15, 0:59:24]: What are those changes though? What why what are those? What are the changes? I'm asking a clerk please. Okay. Clerk, what are those changes that you received? [0:59:25, 0:59:42]: I received the email mayor. I have not had the opportunity to include those and reprint those with amendments. Okay. That that's happened at meetings before. We have before sat here and had the amendments amended, approved with amendments. [0:59:43, 0:59:45]: has been the customary procedure here. [0:59:46, 0:59:46]: All right. [0:59:47, 0:59:57]: Council, you got any suggestions? I do, Mayor. Yes, Magoria, please. Let Councilwoman Barber read the changes that she wants to be made in the amendments. I mean in the in the minutes. Okay. [0:59:58, 1:00:00]: Can't go with you, gentlemen. [1:00:00, 1:00:02]: Go write it, please. Okay. [1:00:05, 1:00:11]: Most of these I provided screenshots of what is actually published and on the city's website. [1:00:12, 1:00:19]: Met for standby. [1:00:21, 1:00:28]: Fer for explanation of what you're referring to. Which set of minutes. There they're five the five before us. Which ones what days you're talking about? [1:00:33, 1:00:34]: August twelfth. [1:00:34, 1:00:45]: Okay, what's August 21st? Hold on, hold on. August twelfth. August 22nd? What is and August 23rd. Okay, for August 12th, what is it that you wanted to change to put in the what in there? Okay, Mayor Ford, if you allow me. [1:00:45, 1:00:49]: To read all the revisions that I sent. I'll be happy to do it. [1:00:50, 1:00:53]: Go right in. Okay. So I sent screenshots. [1:00:54, 1:00:58]: of sections of each of the minutes. [1:00:58, 1:01:00]: And I also provided [1:01:00, 1:01:05]: details of what she needs to correct. Most of these changes, if not all of them, [1:01:05, 1:01:08]: А статименц да I made. [1:01:10, 1:01:14]: No changes to any statements that anyone else made. [1:01:15, 1:01:16]: It looks like [1:01:16, 1:01:19]: My statements were misconstrued or [1:01:19, 1:01:21]: Just not worded. [1:01:21, 1:01:22]: Correctly. [1:01:22, 1:01:24]: So August twelfth. [1:01:27, 1:01:28]: Uh page four. [1:01:29, 1:01:36]: Where it says Council Member Barber stated that while she recognized the owner has a right to sell. [1:01:36, 1:01:40]: There are concerns regarding the rates of the future facility. [1:01:40, 1:01:42]: In comparison to the current rates. [1:01:43, 1:01:45]: And question the security of the access. [1:01:46, 1:01:47]: To the nearby subdivision. [1:01:49, 1:01:50]: My correction to that [1:01:51, 1:01:53]: My statement was that I was curious. [1:01:54, 1:01:58]: To know what the current rates were of the other facilities in comparison. [1:01:58, 1:01:59]: To the current rate. [1:02:00, 1:02:03]: That the existing patients or residents are paying. [1:02:04, 1:02:16]: The next statement I made, I also stated that I watched the Planning Commission meeting when this proposal was presented. I heard the concerns expressed by a resident who lives in the adjacent neighborhood. [1:02:16, 1:02:17]: The villages. [1:02:18, 1:02:19]: Regarding access [1:02:19, 1:02:20]: to their neighborhood. [1:02:21, 1:02:22]: I asked the [1:02:22, 1:02:28]: Potential new property owner if she has plans to restrict access into the adjacent neighborhood. [1:02:29, 1:02:31]: That was not included in the minutes, but it should be. [1:02:33, 1:02:34]: The next minutes. [1:02:34, 1:02:36]: August twenty second. [1:02:36, 1:02:38]: That was the retreat. [1:02:40, 1:02:43]: Um didn't include the page number. [1:02:43, 1:02:50]: But in the meeting minutes, it reads, Councilwoman Barber asked about the city's newsletter. [1:02:50, 1:02:52]: Noting only one copy. [1:02:53, 1:02:54]: Went out. [1:02:55, 1:02:55]: Two [1:02:56, 1:02:58]: The newly annexed residents. [1:02:59, 1:03:00]: That's not what I said. [1:03:01, 1:03:03]: I stated that I would be um [1:03:05, 1:03:08]: А сед а стати да онлива ньюзлетер. [1:03:08, 1:03:12]: was published and mailed out in twenty twenty three. [1:03:12, 1:03:18]: Noting that the newsletter was not sent to the newly annexed residents. [1:03:22, 1:03:22]: Continue. [1:03:23, 1:03:25]: Yes, go ahead. [1:03:25, 1:03:27]: Um then there's another section. [1:03:28, 1:03:34]: Councilmember Barber noted there needs to be more focused on recruitment and interns for departments. [1:03:35, 1:03:36]: Um [1:03:38, 1:03:41]: I said I inquired about internships. [1:03:42, 1:03:43]: Please correct. [1:03:43, 1:03:45]: Not interns. [1:03:46, 1:03:48]: My question was to the [1:03:48, 1:03:49]: HR director. [1:03:50, 1:03:51]: The next one? [1:03:52, 1:03:53]: Please correct. [1:03:53, 1:03:54]: I said [1:03:54, 1:03:56]: Councilmember Barber noted. [1:03:56, 1:04:00]: The city has imposed a city tax on the residents. [1:04:00, 1:04:02]: And increase the cost. [1:04:02, 1:04:05]: for the entertainment for residents and non-residents. [1:04:06, 1:04:10]: That is what's noted in the minutes, but that's not what I said. [1:04:11, 1:04:15]: Вот I said was year over year there has been an increase. [1:04:16, 1:04:17]: To the proposed budget. [1:04:18, 1:04:19]: For free entertainment. [1:04:20, 1:04:21]: That's what I said. [1:04:22, 1:04:23]: For the record. [1:04:25, 1:04:28]: Then there is another section of that same meeting. [1:04:29, 1:04:41]: Councilmember Barber noted that there is a$2 million budget approved by the Council for the Amphitheater Consultant and Expenditures and asked who is responsible for reconciling the amphitheater reports. [1:04:43, 1:04:44]: That's what's in the minutes. [1:04:45, 1:04:47]: What I asked is for her to please correct. [1:04:48, 1:04:51]: Noted that there are two milyen dollars budgeted. [1:04:51, 1:04:52]: That was approved by the council. [1:04:53, 1:04:55]: For the operations of the amphitheater. [1:04:55, 1:04:57]: Also noted that budget amendments [1:04:58, 1:04:59]: should be presented. [1:04:59, 1:05:00]: To the council. [1:05:01, 1:05:02]: No, they haven't been. [1:05:03, 1:05:04]: I said that too. [1:05:08, 1:05:08]: The next one. [1:05:10, 1:05:10]: Same day. [1:05:12, 1:05:13]: Councilmember Barber. [1:05:13, 1:05:16]: Made a request to Mayor Ford. [1:05:17, 1:05:19]: to appoint to be appointed. [1:05:19, 1:05:22]: Chair of the Finance Committee. [1:05:22, 1:05:30]: And noted, she is the only member of the count council currently not serving on a board or committee in any capacity. [1:05:31, 1:05:33]: My correction to her was that [1:05:33, 1:05:34]: Please correct. [1:05:35, 1:05:38]: Council member Barber made a request. [1:05:38, 1:05:42]: of Mayor Ford to reactivate the finance committee. [1:05:42, 1:05:43]: I also said [1:05:44, 1:05:48]: Та чи во данно в фінанс коміті. [1:05:49, 1:05:50]: And note it. [1:05:51, 1:05:54]: I am the only member of the council who is not serving. [1:05:54, 1:05:57]: as a council liaison on a board or committee. [1:06:00, 1:06:03]: The clerk was the one who advised. [1:06:03, 1:06:04]: She's the one. [1:06:05, 1:06:08]: Who advised that the mayor has the responsibility? [1:06:08, 1:06:09]: Of appointing the chair. [1:06:10, 1:06:11]: to the finance committee. [1:06:13, 1:06:16]: I had asked to be the council liaison. [1:06:17, 1:06:23]: That was my original request, but that's not in the minutes. So it just looks as though I asked the mayor. [1:06:24, 1:06:25]: To just make me a chair. [1:06:26, 1:06:28]: But it doesn't show. [1:06:28, 1:06:32]: That the city clerk advised or informed the council. [1:06:33, 1:06:37]: That the ме the mayor has the responsibility of appointing the chair. [1:06:37, 1:06:39]: So all of this is really [1:06:40, 1:06:44]: small little details, but I'm gonna continue on because you asked me to. [1:06:53, 1:06:55]: The next one is August twenty third. [1:06:58, 1:07:00]: Um and [1:07:01, 1:07:03]: Page is this. Page four. [1:07:04, 1:07:10]: Councilmember Barber asks what the impact is on the city when shows are canceled. [1:07:11, 1:07:13]: I asked her to please correct. [1:07:14, 1:07:18]: What I asked was what is the impact to the amphitheater budget? [1:07:19, 1:07:22]: when concerts are cancelled or rescheduled. [1:07:23, 1:07:23]: And then [1:07:24, 1:07:24]: After [1:07:25, 1:07:27]: I got a response from Mr. Young. [1:07:27, 1:07:28]: I followed up. [1:07:28, 1:07:29]: By asking [1:07:30, 1:07:33]: Why would we pay a hundred percent of the expenses? [1:07:33, 1:07:38]: For the rescheduled concerts due to factors that are out of our control. [1:07:38, 1:07:39]: Such as the weather. [1:07:40, 1:07:45]: And ask, are there rescheduled shows being renegotiated? [1:07:46, 1:07:47]: So I want that added. [1:07:49, 1:07:50]: Then there is [1:07:52, 1:07:53]: Page. [1:07:53, 1:07:54]: Page four. [1:07:56, 1:08:00]: Councilmember Barber asked if the funds can be reallocated. [1:08:02, 1:08:05]: And she just shows mister Wall confirmed. [1:08:06, 1:08:08]: So I asked her to please clarify. [1:08:09, 1:08:13]: What did Mr. Walls confirm because it's not included in the minutes? [1:08:15, 1:08:16]: Then August twenty first. [1:08:18, 1:08:24]: Councilmember Barber asked who is responsible for reviewing the city's housing inventory? [1:08:27, 1:08:34]: Noting as has been stated, there have been a number of developments approved, specifically [1:08:34, 1:08:46]: multifamily developments, noting there has been a lack of single family detached homes and developments that have come before the council for approval and these types of affordable, [1:08:46, 1:08:47]: Developments are what are needed [1:08:48, 1:08:50]: In the city. That's not what I said. [1:08:52, 1:08:54]: But Miss Holliday, of course. [1:08:55, 1:08:57]: She's it's not being recorded. [1:08:58, 1:09:01]: These were all minutes taken during the council's retreat. [1:09:03, 1:09:05]: So what I asked her is [1:09:06, 1:09:07]: I reiterated. [1:09:07, 1:09:10]: That diverse housing options are needed. [1:09:11, 1:09:11]: Please correct. [1:09:12, 1:09:14]: There have been more than [1:09:15, 1:09:16]: There have been [1:09:16, 1:09:20]: More multifamily developments approved by a city council [1:09:21, 1:09:22]: For district four. [1:09:23, 1:09:26]: There have been a lack of development proposals. [1:09:26, 1:09:27]: Four [1:09:27, 1:09:29]: Single family detached homes [1:09:30, 1:09:31]: Present it to the council. [1:09:31, 1:09:35]: And that diverse housing options are needed in the city. [1:09:36, 1:09:37]: I'll continue. [1:09:37, 1:09:38]: What? [1:09:38, 1:09:58]: I know, but point of order. We are wasting the citizens' time with petty items. These people, I know they don't want to sit here all night and listen to this. It it might be better that we table this, come back, read the notes. Everybody can come back and have a detail to it. How many more do how much more time? [1:09:58, 1:10:07]: Time do you need to for us to delay the meeting? That's all I'm asking. How much we have to do. Well, no, I don't need any time. Your mayor asked me to do this, so I am. [1:10:08, 1:10:15]: Um I I'm not here to play any games. Never has this council ever been asked [1:10:16, 1:10:18]: To provide [1:10:19, 1:10:25]: What corrections they submitted to our meeting minutes. We what not necessarily meet. [1:10:26, 1:10:29]: The rules seem to always change when it comes to me. [1:10:30, 1:10:38]: I'm here for it. So if you have some more, listen so we so we can approve this if or whatever the case the council's gonna decide you how much more do you have uh to mention here? A lot more. [1:10:39, 1:10:52]: Exactly. Let's table this and then bring it back to the next meeting so everybody can read it. Come forward. We can't not sit here and now we got a bunch of s business, actual business to conduct. This is this is ludicrous. [1:10:52, 1:10:56]: Mayor Ford. Mr Mr Thomas, please. [1:10:57, 1:11:11]: I'm I'm gonna yield to to the clerk. Oh, go ahead, clerk comment. Mayor, just just to be clear for everyone to know, the city of Stockbridge, the charter states that minutes are done by summary. [1:11:12, 1:11:14]: Not verbatim. Right. [1:11:15, 1:11:24]: And the retreat is those meetings were not televised, they were not recorded, those are handwritten notes. [1:11:24, 1:11:29]: And they are by summary, they are not verbale. [1:11:29, 1:11:39]: I try to take what content comes out of those meetings and summarize those meetings as best that I can to [1:11:39, 1:11:40]: Brains. [1:11:40, 1:11:45]: To the history, what has happened at the meeting is not verbatim. [1:11:47, 1:11:53]: All right. Mr. Thomas. [1:11:53, 1:12:00]: Uh Mayor and Council, uh I I I think it would serve all of us best. [1:12:00, 1:12:02]: It will allow [1:12:02, 1:12:05]: Councilwoman Barber to [1:12:05, 1:12:16]: get with the city clerk to ensure that her comments were properly um recorded and noted. [1:12:16, 1:12:18]: And we bring the minutes back. [1:12:19, 1:12:24]: Once all of the corrections have been made. I tried to take notes here. [1:12:24, 1:12:26]: Um it it's a lot to try to [1:12:27, 1:12:28]: Field the end, but [1:12:29, 1:12:41]: I think it would serve all of us best. A second thing. If if the clerk and Ms. Barber get together with the record and bring all of the minutes back with all of the corrections, all of the updates. [1:12:41, 1:12:52]: And we approve of the minutes that way. Uh and I think that would serve all of us best. I think Councilwoman Barber, if this would satisfy you to make sure that [1:12:52, 1:12:53]: Your comments. [1:12:54, 1:12:56]: Excuse me. If your comments [1:12:57, 1:12:59]: or properly recorded. [1:12:59, 1:13:01]: Then we can all come back. [1:13:01, 1:13:04]: And approve the minutes. [1:13:04, 1:13:07]: If that's okay, I think that would serve all of us best. [1:13:08, 1:13:10]: I'm taking that as a motion to table council member [1:13:11, 1:13:31]: Yes. Yes, I I I will second that motion uh and certainly uh agreed to do that, understanding that this is uh what what needs to happen and in defense of the clerk. But that she's she stated accurately. This is a summary. I look at those notes, I trust her, and I think she's gonna do the right thing. So thank you. [1:13:31, 1:13:40]: Mel Foy, please in that motion, and if Councilwoman Barber's okay with it, just let Mrs. Barber [1:13:40, 1:13:55]: And the clerk get together and correct the minutes. I don't think we need any more comments about it. And if that is satisfied everyone, we'll come back and approve the minutes with those corrections. Second. Thank you. [1:13:57, 1:13:59]: I'm assuming Miss Barber, you all right with that? [1:14:00, 1:14:05]: If I may second the motion, I would. Well it's already it's already been second. All in favor of the motion, please indicate. [1:14:06, 1:14:10]: All right, fantastic. Okay, let's move on. Um, Madam Clerk, do we have any public comments at all? [1:14:11, 1:14:14]: We do have one public comment from Mr. [1:14:15, 1:14:16]: Tim Callahan. [1:14:16, 1:14:20]: All right, sir. Come on up, please. [1:14:25, 1:14:30]: Good evening, folks. Good evening. Name and address, please, sir. Tim Callahan, 146, Oakwood Circle. Okay. Stockbridge. [1:14:31, 1:14:51]: Uh, I'm coming to you uh in light of uh the recent developments of uh expansion of the Westside Connector and added housing units on Hudson Bridge Road. Uh recent traffic study uh presented to the city marked up that area as service level E, meaning that it's a very poor traffic zoned area. And I asked that the council [1:14:51, 1:14:52]: [4493.0, 4498.1]: Putting some scrutiny to any developments in the area related to that traffic tie up. [1:14:58, 1:15:02]: Uh, particularly along Hudget Bridge Drive, where uh [1:15:03, 1:15:11]: People just kind of ignore the the traffic markings on the uh I believe it's north side of Hudson Bridge Drive. Um [1:15:11, 1:15:23]: The new developments that are proposed are going to add traffic, the expanded traffic with the ex uh West Side Connection, which I applaud. I will bring more traffic through there as well as flip and road, which I know you don't control. [1:15:23, 1:15:35]: But I do ask that as you consider the developments in this area, please expand that consideration to the fact that it will cause a substantial amount of traffic flow through there and the investment is gonna fall to the city, not to the developers. [1:15:36, 1:15:38]: Appreciate it. Thank you, sir. Appreciate your comments. [1:15:39, 1:15:43]: On that note, ladies and gentlemen, we before we had our actual meeting, of course, several. [1:15:46, 1:15:47]: Okay. Mr. Glenn? [1:15:47, 1:15:48]: Call him forward, please. [1:16:01, 1:16:07]: Name and address, please, Mr. Glenn. Mark Glenn, uh 199 Eagles Club Drive, Stockbridge. [1:16:09, 1:16:10]: Oh yeah, please. [1:16:11, 1:16:31]: My comment is is around the uh zoning request. I believe it's on item number six. That's correct. Um Mr. Glenn, you're not able to speak to any item on the agenda and it has to be a non-agenda item for public comments. You're welcome to speak during the public hearing portion of the meeting. [1:16:31, 1:16:32]: For that particular item. [1:16:32, 1:16:40]: Oh, okay. All right. Thank you. I appreciate it. Mayor Ford. Yes, yes, ma'am. Um, I made a request to amend the agenda. [1:16:40, 1:16:42]: Um and one of the items. [1:16:43, 1:16:44]: was not addressed. [1:16:45, 1:16:57]: That was council discussion to a fine to define a policy or procedure to dispose of city owned real estate properties. I believe you asked that there's no second to the motion. [1:16:58, 1:17:18]: That's right. There was no second to the motion. There was no second to the motion. That's why. That's why we moved on. And we'll continue to move on. Thank you, sir. Thank you. All right. So uh on the ceremonial uh part of the meeting, prior to prior to the meeting, we have several different proclamations to identify the Hispanic Heritage Month, which is from September 15th to October 15th. Um, Mr. Jimmy Floyd. [1:17:18, 1:17:38]: Fleming retired from Vulcan Materials, been a very uh very good partner uh with the city of Starbries and with the community. Uh well over a 30-year relationship with uh Falcon, of course, and with our our community. And what he mentioned in his comments, if I recall distinctly that uh Vulcon Materials has had the long [1:17:38, 1:17:44]: long standing relationship with Stockbridge in the um in the quarry and the the material [1:17:44, 1:18:04]: industry more than any other place that they've have ownership of. So they've been in the community for many, many years. Um Georgia Reed's proclamation and and in a sense was uh was read as well, uh introducing and and acknowledging the uh Georgia Reed's and for our children in our schools, trying to [1:18:04, 1:18:24]: allow them and give them more access to reading. And we also had a proclamation for National Uh Assistant Living Week identifying those individuals that live in assistant living facilities. And our water department and uh well actually our water plant and a water treatment plant both received platinum and gold awards for their outstanding [1:18:24, 1:18:44]: work and what it amounts to is that uh when it comes to public works, there's something that uh I guess a lot of times we take for granted. They do do a lot of heavy lifting and for the infrastructure and on the mission for the city itself. Um but we don't talk about that enough. We have other things typically we talk about, but they've obviously they've been doing [1:18:44, 1:18:49]: extremely well to receive these awards over the course of the the last twelve years or so. [1:18:50, 1:19:08]: And then uh swore several individuals into the Public Facilities Committee, the DDA and our ethics uh board. Uh I believe I covered all those, so we had a very extensive uh ceremonial portion of our meeting tonight. And on that note, um move on. [1:19:11, 1:19:22]: to a presentation. The presentation deals with the FY twenty twenty three audit report presented by uh Hope Penegrass of Malden and Jenkins and involving also Ms. Gaines as well. [1:19:24, 1:19:24]: Thank you. [1:19:26, 1:19:29]: Good evening, Mayor and Council. How are you doing this evening? Evening. [1:19:29, 1:19:37]: Uh Marlon and Jenkins are here to present the FY23 budget. We have Hope Prendergrass and her associate, Mr. Kirk Erich. [1:19:46, 1:19:48]: Appreciate you uh appreciate the fact that you all are here. [1:19:51, 1:19:55]: Thank you, Mr. Mayor. Council, I appreciate the opportunity to come and speak to you all today. [1:19:56, 1:20:10]: I did put together a short PowerPoint presentation that will um essentially summarize the information that's already been included in your agenda packet. There are no there's no new information here, but I just kinda wanted to have a visual aid to assist me. [1:20:18, 1:20:36]: So, um, we're here today to talk about the 2023 audit. Uh, we'll be going through a few things, tell you a little bit more about your engagement team at Malton and Jenkin. We'll talk about the results of the audit, some financial trends, upcoming GASBE pronouncements. GASBY is the governing body that governs the accounting. [1:20:37, 1:20:42]: um policies and financial reporting for governments and then I'll be happy to address any questions you may have. [1:20:44, 1:21:02]: So I think y'all are familiar with us. Moln and Jenkins audits more than seven hundred and twenty-five governments throughout the southeast, across six states, including fourteen offices. 180 plus of those entities are cities like yourself. Some just as small as a few thousand people, all the way up to the city of Atlanta itself. [1:21:05, 1:21:15]: Um there are certain things that we are required to report to you all by the auditing standards. One of those is that our responsibility, um [1:21:15, 1:21:21]: is that we audit the financial statements. It's management's responsibility to take ownership of those financial statements. [1:21:25, 1:21:40]: So for the fiscal year ended 1231 23, we did have an unmodified or clean opinion on your financial statements, meaning that we determined that they are materially correct in accordance with generally accepted accounting principles for governmental entities. [1:21:41, 1:22:01]: Um you also have other reports that are included in your annual comprehensive financial report or your ACFER. This includes the report on internal control as well as something that y'all don't have every year, but some years it just depends on the level of federal funding that you have. You also have a report on your federal program. [1:22:01, 1:22:06]: in accordance with the uniform guidance. We did have um [1:22:07, 1:22:27]: Six findings this year. It looks like I left off a bullet, but we had um five having to do with your financial statements and one having to do with your federal programs. None of these are anything that I don't think is easily correctable. The city had a lot of stuff going on this year, had a newer finance staff, so we did have some things that need to be tightened up for next year, but I see that. [1:22:27, 1:22:31]: that the the staff you have in place should be able to accommodate that easily. [1:22:33, 1:22:53]: So again, you had a single audit which is performed in accordance with the uniform guidance. We tested two of your major federal programs, one of that being your coronavirus state and local fiscal recovery funds. A lot of times those funds are referred to as ARPA funds because ARPA was the federal appropriation of those funds. We also tested your COPS grant. [1:22:53, 1:22:57]: Those grants were new this year because you all have a um police department. [1:22:58, 1:23:00]: So you were getting those grant funds? [1:23:01, 1:23:16]: Um we did have what we call an unmodified or clean opinion on your CSL FRF. We did have a qualified opinion on your COPS grant. That just means that there was one area of which we could not report as a clean opinion and that had to do in regard to reporting. [1:23:18, 1:23:31]: These next few slides include our required communications. Again, we are required by the standards to communicate to you all certain things. As far as your significant accounting policies, those are described in your ACFER in note one. [1:23:33, 1:23:53]: Um this year, GASME 96. Again, GASME is the authoritative body that governs financial reporting for entities like yourselves. This one had to do with subscription-based information technology arrangements. So we had to consider that. That would be where y'all are paying over multiple years for some kind of license to use a software. So we had to consider. [1:23:53, 1:24:00]: Consider that and the reporting thereof, but we it was determined that there were no material agreements to report under that standard. [1:24:01, 1:24:08]: Um your s your statements include various estimates and we determined that those were proper. [1:24:10, 1:24:28]: And there are certain footnote disclosures included in your um ACFAR that I always tell people is good bedtime reading, but those are included in there. We did receive full cooperation from management and staff and had no disagreements on accounting issues or for n financial reporting matters. [1:24:30, 1:24:50]: Um there were no past adjustments, which means all the adjustments that we proposed were accepted by management. We did have several audit adjustments again as I referenced earlier, and as you all know, you have a newer accounting staff, and so we did um have several accounting adjustments. Um those were provided to and discussed with management. [1:24:50, 1:25:05]: As part of the audit completion each year, we require um representation from management, i.e., you've told us everything, you've given us everything that you know, and so we had no issues obtaining that representation from management. [1:25:06, 1:25:12]: We are not aware of any consultation with other accountants, and again there were no significant issues discussed with management. [1:25:14, 1:25:21]: Um, let's see. The important thing here is that we are considered to be independent in regard to the city. [1:25:24, 1:25:44]: The next session talks briefly about financial trends. So this is a five year history of your revenues and expenditures. Um as you'll see there, your revenues are in the and transfers and other financing sources are in the gold. Um the dark gray color is your expenditures. So this year your revenues did outpace your expenditures. [1:25:44, 1:25:56]: And on this next slide, we have a five-year history of your expenditures versus your fund balance. You know, there was a period of time that you all had fund balance in excess of your annual expenditures. [1:25:56, 1:26:15]: With the implementation of a lot of your initiatives in recent years, that's kind of flip-flopped to be more in line with what we see elsewhere at other communities that we work with. As of six uh 1231-23, y'all had approximately 18% of fund balance when you compare it to annual expenditures. [1:26:15, 1:26:16]: Um [1:26:19, 1:26:32]: I've talked about GASME 96. That was it would have been implemented this year if you had any qualified agreements. These next two slides just talk about some of the upcoming GASMEs, things that you will have to implement in the coming years. [1:26:34, 1:26:38]: which we will communicate with management and and advise them as appropriate. [1:26:40, 1:26:57]: And the last thing I want to talk about is part of our service. We provide free continuing education to management and counsel if they should desire to attend when we just talk about emerging topics, things that are relevant to accounting and financial reporting in the governmental industry. We've been doing that for about fifteen years now. [1:26:58, 1:27:00]: And um we do about once a quarter and we have about [1:27:00, 1:27:17]: Let's see, this last time we had about 250 different people from various entities attend. So should that be something that you're interested in, if you want to learn about debits and credits, we'd um like for you to attend. The information on how to attend is included in the slideshow as well as in the um information that you received earlier. [1:27:18, 1:27:27]: Thank you for your briefing and uh for your continued support and uh and being uh our auditor for the city stoppage all these years. Council questions. [1:27:30, 1:27:34]: Thank you. [1:27:35, 1:27:43]: Hi. Hey. I have a lot of questions. Okay. Um, most of them are procedural questions. Yes, ma'am. Okay. [1:27:43, 1:27:54]: Is your email address H P E N D E R G R A S S at M J C P A dot com? Yes, ma'am. Okay. [1:27:54, 1:27:57]: I sent four emails last year. [1:27:57, 1:27:58]: Requesting [1:27:58, 1:28:01]: The audit results from twenty twenty two. [1:28:02, 1:28:10]: And I didn't get a reply back. So I just wanted to confirm your email address. Um the other question I have is. [1:28:12, 1:28:19]: And you tell me. Okay. Because I'm trying to get a better understanding of this process. And I know how our city [1:28:19, 1:28:20]: has been handling [1:28:21, 1:28:23]: The audit since I've been here. [1:28:23, 1:28:24]: But I'm concerned. [1:28:25, 1:28:27]: So to maintain the integrity. [1:28:27, 1:28:28]: Of the audit. [1:28:28, 1:28:35]: Because it is a independent audit. Yes, ma'am. Independent from any other report. [1:28:35, 1:28:37]: The staff provides [1:28:38, 1:28:40]: When you send the audit results. [1:28:42, 1:28:44]: They're supposed to come from your hands. [1:28:45, 1:28:46]: Into our hands. [1:28:47, 1:28:49]: Not from your hands. [1:28:50, 1:28:51]: To staff's hands. [1:28:52, 1:28:53]: For staff to give to us. [1:28:54, 1:28:55]: And that is exactly [1:28:56, 1:28:57]: What happened this year? [1:28:59, 1:29:00]: Last year. [1:29:01, 1:29:05]: In previous years, I'm not saying anybody is doing anything wrong. [1:29:05, 1:29:08]: I just don't want to give the appearance that there is. [1:29:09, 1:29:16]: So industry standard and is outlined in our engagement letter is that we provide all our reports to management to provide to the governing body. [1:29:16, 1:29:20]: Okay, who management being the city manager and [1:29:20, 1:29:24]: I usually provide those to to the city of Startbridge City Treasurer. [1:29:24, 1:29:25]: Okay. [1:29:25, 1:29:30]: So to maintain the integrity and the independence [1:29:30, 1:29:31]: Is it [1:29:32, 1:29:43]: appropriate for you as for you to email the results to the governing body so that there's no interference and that we're getting exactly what you report. [1:29:44, 1:29:54]: I mean, I would probably have to do some research because like I said, I mean, industry standard is such that we we provide that information to management to distribute to the governing body. That's laid out in our engagement letter. [1:29:55, 1:29:58]: Okay, so the council doesn't get the engagement letter. [1:29:59, 1:30:00]: So I wouldn't know what [1:30:00, 1:30:03]: You've agreed to in the engagement letter. [1:30:03, 1:30:04]: Until [1:30:04, 1:30:10]: The actual results are provided to us from staff. That's not independent. [1:30:11, 1:30:26]: So it's my previous understanding that the engagement letter was a presented as a council agenda item at the at the annual I think in January when y'all approve several different things. Mr. Gardner is not. Mr. Gardner, come to mic. It is not a good thing. Come to the mic, please. [1:30:26, 1:30:28]: It has never [1:30:28, 1:30:30]: been presented to the council. [1:30:30, 1:30:31]: At the beginning of the year. [1:30:32, 1:30:33]: At the end of the year. [1:30:34, 1:30:38]: Or in the middle of the year, we only get it when we get the audit results. [1:30:40, 1:30:43]: Need your assistance to make resolve this issue, this concern? [1:30:44, 1:30:44]: Yeah. [1:30:44, 1:30:55]: Well, um it is my understanding of the engagement letter I think comes as part of the audit. Um I know when we um [1:30:55, 1:31:05]: When we put the RFP out obviously those um the RFP comes back with their qualifications and all of that information involving it. Can you speak up Mr. Carter? Yes, ma'am. [1:31:06, 1:31:25]: But it's my understanding of it is when y'all get the audit report, I think a copy of the engagement letter is typically included in that in that document, if I'm not mistaken. And I I think as Miss Penegrass said, I mean, everywhere I've worked in the state of Georgia as city manager. [1:31:26, 1:31:29]: And as a department head is my understanding that that document is sent to [1:31:30, 1:31:37]: Either the finance director, city manager, or management staff, and then on to city council. That's my seven years in East Point, that's how it was done. [1:31:38, 1:31:39]: Okay. [1:31:39, 1:31:42]: Well m doctor, you need to stand by. [1:31:42, 1:31:46]: Mr well Mayor Ford, if I may continue please. I didn't stop you, go ahead. [1:31:46, 1:31:47]: Okay. [1:31:47, 1:31:49]: So this is a independent [1:31:50, 1:31:50]: Audit. [1:31:51, 1:31:52]: It is supposed to [1:31:53, 1:31:54]: Be provided. [1:31:54, 1:31:55]: To the governing body. [1:31:56, 1:31:58]: It is for us. [1:31:59, 1:32:01]: It's for the governing body. [1:32:02, 1:32:04]: Not just for staff. [1:32:06, 1:32:12]: So to make sure we're maintaining the independence of your audit results. [1:32:13, 1:32:14]: What I am requesting is [1:32:15, 1:32:17]: Is that if you would please [1:32:18, 1:32:21]: Please email the audit results to the governing body. [1:32:21, 1:32:24]: You can include the city manager. [1:32:24, 1:32:26]: And the treasurer as well. [1:32:27, 1:32:28]: We should all be getting it. [1:32:28, 1:32:29]: At the same time. [1:32:30, 1:32:33]: I'm not saying anybody is doing anything wrong. [1:32:33, 1:32:38]: All I'm saying is it is independent for a reason. [1:32:39, 1:32:40]: Last year [1:32:40, 1:32:42]: I spent ten months. [1:32:42, 1:32:43]: Asking. [1:32:44, 1:32:47]: For the independent audit results. [1:32:47, 1:32:50]: From twenty twenty two financials. [1:32:51, 1:32:53]: Your audit results [1:32:54, 1:32:57]: And I don't know if it was the complete audit or not. [1:32:58, 1:33:02]: All I saw was several pages that were combined. [1:33:03, 1:33:04]: With the CAFA report. [1:33:05, 1:33:08]: The CAFA report is a finance report. [1:33:08, 1:33:11]: that our finance department prepares. [1:33:11, 1:33:12]: So it was all [1:33:12, 1:33:13]: Intermingled. [1:33:14, 1:33:17]: Авнор с орсо пейджет. [1:33:18, 1:33:19]: I couldn't decipher. [1:33:20, 1:33:23]: What was provided by Malden and Jenkins? [1:33:24, 1:33:25]: Or what staff prepared? [1:33:27, 1:33:28]: This is supposed to be. [1:33:29, 1:33:30]: A independent [1:33:31, 1:33:32]: Audit. [1:33:32, 1:33:36]: І тобі сепарт фенітінс. [1:33:36, 1:33:37]: I spent ten months. [1:33:38, 1:33:39]: Asking. [1:33:40, 1:33:44]: Four times I sent emails. So let me ask you this. [1:33:44, 1:33:47]: If I have a question after today. [1:33:47, 1:33:54]: Am I able to reach out to you and ask you questions regarding our FY 2023 financials? [1:33:55, 1:34:02]: The the standard process is the if council has questions and they direct that to management who directs it to us. [1:34:03, 1:34:05]: So we don't have access. [1:34:05, 1:34:07]: to reach out to you directly. [1:34:12, 1:34:32]: Well let me do let me do this. Something I want to ask I'm asking her I understand what you're asking. But representing the CPA firm. I'm understanding. I want to understand what her and the rest of the council. Stand by a second. You should realize that whatever directive you give to any independent contractor is a good idea. I didn't say I was giving anybody any directions. [1:34:32, 1:34:52]: Directly it should be a consensus from the council to Mayor Ford. It should be a consensus from the council if you want something directly. The council needs to make sure I'm not going well for a consensus from the council. Well so that this independent audit result remains independent. Understand it, but any directive that you may give is out of line with the charge. [1:34:52, 1:35:03]: charter and out of line within if we don't get a consensus from the charter mandates that we have an independent audit performed every year. It doesn't tell us how the CPA firm should conduct it. [1:35:04, 1:35:07]: What I'm asking her as a pro [1:35:07, 1:35:10]: As a professional CPA. [1:35:10, 1:35:11]: representative. [1:35:11, 1:35:13]: She knows her processes. [1:35:13, 1:35:15]: She knows where I'm going. [1:35:15, 1:35:19]: This is a independent audit. [1:35:19, 1:35:21]: Supposed to be completely separate. [1:35:22, 1:35:42]: The purpose of the audit is to make sure there is no waste, fraud, or abuse. If there is waste, fraud, or abuse, it makes no sense to give it to staff for them to keep the books, clean it up, re award, fix whatever adjustments they need to make, and then [1:35:41, 1:35:45]: Send it to the council on order. I'm trying to avoid [1:35:45, 1:36:05]: Any more confusion. May I finish the state? There's a point of order. There's a point of order. Right. I've asked questions. Specific questions, please. I'm going if you will stop cutting me off. May I finish? Go ask specific questions. May I finish. Ask specific questions. [1:36:05, 1:36:24]: I ask specific questions, please. May I finish my questions without any interruption? No, no, I can't guarantee that. From this guy right here, may I finish my questions to Miss Pendergrass since I can't get a hold of her outside of these meetings? [1:36:25, 1:36:45]: She does not respond to me via emails. Point of order, I want to make sure that I understand. Mayor Ford it is customized customary procedurally. Right. This is argumentative and going beyond the thr the pale. Mayor Ford, Mr. Elder. May I finish my question? Mr. [1:36:44, 1:36:47]: I understand, understand. [1:36:48, 1:37:08]: We cannot give you directives unless there are directives on anything unless the entire council agrees to that. You you mentioned about your Pacific Industries, which is to the staff. The fifth city manager is the point of contact there in that aspect. So things, if things go if that happens, it goes to city manager, the city manager needs to give it to the council, unless the council has a claim. [1:37:08, 1:37:13]: Not one individual, not even me. [1:37:13, 1:37:14]: Okay? [1:37:15, 1:37:20]: continue on with answering specific questions that Miss Barber may have. [1:37:21, 1:37:23]: Thank you. May I finish? [1:37:24, 1:37:27]: Without you interrupting me. I can't guarantee that. Go ahead. Okay. [1:37:28, 1:37:29]: Aut of respect. [1:37:30, 1:37:31]: To the council. [1:37:32, 1:37:33]: To the public. [1:37:33, 1:37:35]: And the people who are here. [1:37:35, 1:37:37]: I'm going to keep fighting. [1:37:37, 1:37:39]: For transparency. [1:37:39, 1:37:44]: And the way we govern and the way we do business. [1:37:44, 1:37:47]: We have a contract with Malden and Jenkins. [1:37:48, 1:37:51]: They do what we need for them to do. [1:37:52, 1:37:54]: They are a contractor. [1:37:55, 1:37:59]: I don't know. Ask her specific questions, please. Miss Pendergrass. [1:38:00, 1:38:04]: The engagement letter. Is it signed by management? [1:38:04, 1:38:06]: Yes, ma'am. Okay. We don't have a copy. [1:38:07, 1:38:10]: Of the signed page of the engagement letter. [1:38:12, 1:38:15]: We just have this one page right here. So where's the second page? [1:38:15, 1:38:29]: That's the that's the management letter. The document that you're holding up appears to be the management letter'cause it has our signature at the bottom. The engagement letter um I think was on the agenda, but I agree it was the unsigned copy. I'm not sure why the signed copy wasn't posted. [1:38:29, 1:38:33]: Okay, so yeah, there's a lot of issues. [1:38:34, 1:38:39]: The engagement letter is what I asked for last year and I was expecting it this year as well. [1:38:40, 1:38:43]: All I want is to get a understanding [1:38:43, 1:38:45]: Of what you [1:38:45, 1:38:50]: are supposed to do and what I'm supposed to do. I want to be able to do my job. [1:38:51, 1:38:57]: I can't trust the results of your audit if it's being passed along. [1:38:58, 1:39:04]: And I don't know what changes and I'm not saying that staff or anyone has done anything wrong. [1:39:05, 1:39:13]: All I want is to make sure that it comes from your hands into my hands. So there there's no compromise in between. [1:39:14, 1:39:18]: Absolutely not. My my councilmates see no issue. [1:39:19, 1:39:21]: They see no issue with it. I do. [1:39:21, 1:39:24]: Because it gives way to um [1:39:26, 1:39:27]: Other things. [1:39:27, 1:39:29]: And that's not what we want here. [1:39:30, 1:39:35]: All I want is when I have questions, I want to be able to ask you directly. [1:39:35, 1:39:46]: So going forward, any contractor, I don't care who it is, if I have questions, I I want to be able to ask them directly. I don't wanna have to ask staff to ask the contractor. [1:39:48, 1:39:49]: That's an issue for me. [1:39:50, 1:39:51]: Um the other thing [1:39:52, 1:39:55]: The budget adjustments, I asked for them. [1:39:56, 1:39:56]: Last year. [1:39:57, 1:39:59]: Фоні твої ту фінаншил. [1:39:59, 1:40:03]: You said that you sent them to management, and if you had not sent them, you would send them [1:40:04, 1:40:05]: Well, I never got them. [1:40:06, 1:40:13]: They were provided to management. I'm not sure what the process is to provide documents to council. This is what I'm talking about. Right here. [1:40:13, 1:40:24]: I've asked for budget adjustments. You mean the audit adjustments? Because we don't do budget adjustments. Well, the adjustments that staff made as a result of [1:40:24, 1:40:39]: Your communications Yes ma'am, that would be audit adjustments, not audit adjustments. You're right. Thank you. I'm sorry. Audit adjustments. Those audit adjustments are what I asked for last year and I want them this year. [1:40:39, 1:40:41]: And going forward, I want them. [1:40:41, 1:40:43]: My countsmates, they don't read anything. [1:40:43, 1:40:45]: They don't read contracts or anything. I do. [1:40:46, 1:40:47]: So I like to have those. [1:40:48, 1:40:49]: Um [1:40:51, 1:41:07]: Again, I want to make sure the integrity of your report um remains whole and uncompromised. I would I am requesting that you send your audit results directly to every member of the governing body. [1:41:07, 1:41:08]: At the same time that you send it. [1:41:09, 1:41:12]: To staff, so we don't just get it on the back end. Thank you. [1:41:13, 1:41:33]: Mayor. Mr. Alexander, go ahead, please. Thank you, uh Mr. P Ms. Pendle. I I thank you for being patient with us and uh answering all of the questions that have been placed upon you. The audit process, you said Maldon and Jenkins audit how many cities in Georgia? Over a hundred well, we audit 180 throughout the southeast, across sixty. [1:41:33, 1:41:34]: States. [1:41:34, 1:41:54]: Okay. What you are doing here in Stockbridge is similar in what your format is that you're doing in all the It's the exact same. If we had a a city of two thousand people or if we had the city of Atlanta. [1:41:54, 1:41:55]: Throughout the southeast. Yes, sir. [1:41:56, 1:42:16]: I appreciate what you've done, the work that you put in and the process that you have put forward. And I want to thank you. And I want to s echo what the mayor has has indicated to you. It requires a consensus, a vote of the council and the mayor to make any changes to whatever that process might be. Now I I'm glad that you're going to be able to do [1:42:16, 1:42:36]: You that question was asked, and what you stated was the process that we're following is consistent with what you've seen in in other jurisdictions as well. Okay, in terms of um you've been with us over time, and congratulations that you have been awarded again and brought back because of your expertise uh in this in this area. [1:42:36, 1:42:52]: area. Thank you, sir. We appreciate the opportunity to continue to serve the city. Right. And as far as the financial, overall financial of the city, as a general consensus or comparison to where the rest of the cities are or is the average city in Georgia, where would Stockbridge be? [1:42:53, 1:43:07]: Um, the the city is is doing well. Um, you know, y'all have had s a lot y'all did a lot of new stuff all at the same time. Mm-hmm. And so that has presented challenges, but I feel like staff is working through that well and will continue to do so. [1:43:08, 1:43:16]: Okay. Uh thank you so much for giving us the good news. Thank you. Yes, sir. Any other counseling you got any comments? Mr. Thomas Gway, please. [1:43:16, 1:43:20]: Thank you. And Miss Pendergrass, thank you as well. [1:43:20, 1:43:21]: Um uh [1:43:22, 1:43:27]: I I do wanna speak to a couple of things and and I'm a little disturbed somewhat because [1:43:27, 1:43:30]: I'm a process kind of a person. [1:43:30, 1:43:36]: And all of us here we're duly elected by our citizens here in the city of Stockbridge. [1:43:38, 1:43:42]: And my concern is if one council member [1:43:43, 1:43:45]: has a question. [1:43:47, 1:43:49]: The process should [1:43:50, 1:43:53]: allow that question to go forward. [1:43:54, 1:43:55]: Uh so I'm I'm sorta [1:43:56, 1:44:01]: throwing this out to our city manager and and to our finance department. [1:44:02, 1:44:08]: It shouldn't be where one question from one council member [1:44:08, 1:44:09]: Get stifled. [1:44:10, 1:44:12]: And not being answered. [1:44:14, 1:44:15]: You know, we're all duly elected. [1:44:16, 1:44:18]: And and and and [1:44:19, 1:44:21]: And I I'm just talking about a process now. [1:44:24, 1:44:32]: If any of us have questions, it not only with our auditor, but any question we have with any contract, any anything that we do. [1:44:33, 1:44:35]: If a question come forward [1:44:37, 1:44:39]: It need to be answered. [1:44:39, 1:44:40]: Now [1:44:41, 1:44:42]: If the process is [1:44:44, 1:44:48]: It goes to the city manager and the city manager sends it to you. [1:44:48, 1:44:53]: if it goes to the treasurer and it's send it to you. But my my issue is [1:44:53, 1:44:57]: The question needs to be answered. [1:44:57, 1:44:58]: Number one. [1:44:59, 1:45:01]: So let me ask you this question. Um [1:45:02, 1:45:03]: What date is [1:45:04, 1:45:07]: Did you send this report to the city of Stockbridge? [1:45:07, 1:45:08]: July thirtieth. [1:45:12, 1:45:13]: July thirtieth. [1:45:15, 1:45:19]: Okay, and today is uh September. [1:45:20, 1:45:34]: I don't recall when we actually got this information. Mr. Thomas Gway, please. So I'm I'm just gonna end with this and cause I I I don't want this opportunity [1:45:35, 1:45:36]: To get [1:45:40, 1:45:47]: Go ahead, go ahead, sir. Go ahead, Miss Ms Thomas. I I don't want this issue to to go by without some clarity. [1:45:48, 1:45:50]: You know, and it and it's all about [1:45:51, 1:45:52]: Being efficient. [1:45:53, 1:45:55]: And being effective in government. [1:45:56, 1:45:59]: And the audit is a very important [1:46:00, 1:46:03]: process for any municipality. Yes, sir, I agree. [1:46:04, 1:46:07]: So that's why I'm speaking the way I'm speaking. [1:46:07, 1:46:09]: Дизінформа [1:46:10, 1:46:12]: It is very important. [1:46:12, 1:46:14]: To all of us. [1:46:14, 1:46:16]: It helps us to [1:46:17, 1:46:19]: [6380.2, 6393.1]: And so we can prepare for the future. So that's why I'm I'm sorta saying let's not just scheme over this this concern that we're in right now. I I think it is important that we clear up this process. [1:46:34, 1:46:36]: You know of questions. [1:46:36, 1:46:42]: And and and I still say and I I just don't like the fact that when a council person has a question [1:46:42, 1:46:45]: And that question cannot get answered. [1:46:46, 1:46:49]: It should always be answered. But [1:46:49, 1:46:51]: It's about the process. [1:46:52, 1:46:56]: It shouldn't be bare the question should not be buried in [1:46:56, 1:47:00]: A process that cannot come forward and and that's my concern. [1:47:01, 1:47:01]: So [1:47:02, 1:47:06]: And I'm going close here, but I just want this council to understand that [1:47:07, 1:47:08]: All of us. [1:47:08, 1:47:13]: a duty elected by the people. We all have a responsibility. [1:47:14, 1:47:15]: Some of us may be [1:47:16, 1:47:20]: feel more about our responsibility than others. That's okay. [1:47:21, 1:47:22]: That's life. [1:47:24, 1:47:25]: But the question [1:47:26, 1:47:29]: should be answered. And I'm saying this to the city manager. [1:47:30, 1:47:45]: The question should be answered to the treasurer. The question should be answered. It should not be stifled. It should not be stopped. It should not be buried. The question should always be answered. So we still have to talk about the process. [1:47:46, 1:47:50]: And if the process is the process then [1:47:51, 1:47:59]: We wouldn't be arguing now. The the process will lend itself to all questions being being answered. So [1:47:59, 1:48:02]: Let's just sort of get the process correct. [1:48:03, 1:48:09]: I yield back, Mayor, thank you. Um Mr one second. Mr Gardner, you stepped to the podium. You want to say something, sir? [1:48:09, 1:48:29]: Yes, sir. Um and and you're correct, sir. The process is important and you're correct too, uh, council member. Um as I mentioned to you guys at our retreat that this would be coming forward or this meeting, and the reason why I think Hope got sick, the reason we didn't get it at the end, I think he was sick or something in August. [1:48:29, 1:48:31]: Uh if I'm not mistaken. [1:48:31, 1:48:43]: So we issued the audit, please. We issued the audit on July thirtieth and this I think was the first me like I was too late to get on August. So this is the first meeting I was requested to attend. [1:48:43, 1:48:46]: And that's what I mentioned to council that it was coming on this date. [1:48:46, 1:48:49]: Right, if you're not if you remember correctly. So [1:48:49, 1:48:50]: First of all. [1:48:51, 1:48:56]: You know, no one's here to do any malfeasins. Like you, you you have a fiduciary responsibility, so do I. [1:48:56, 1:49:02]: Um I take my years of experience and my hard work to get me to this point very seriously. [1:49:02, 1:49:04]: And as I tell people I don't look good in orange. [1:49:04, 1:49:05]: And a jumpsuit. [1:49:06, 1:49:06]: I [1:49:08, 1:49:19]: So I I wanted to be clear that nobody's here is engaging in any farm foolery, stealing of money, misappropriation of funds, and the hint thereof is disturbing to me. [1:49:20, 1:49:20]: Mm-hmm. [1:49:24, 1:49:44]: Ms. Gantt, go ahead, please. Thank you, Mayor. And um Mr. Gardner, I'm glad you said that because that was part of my comment. Um I believe that we are all transparent. We I believe that we are doing the best that we can for the city of Stockbridge. And I also believe that we normally we don't reinvent the wheel. [1:49:44, 1:49:44]: [6585.2, 6586.2]: You've heard [1:49:46, 1:50:04]: you know, from our auditors who we voted to hire again for the next year, that this is customary, that this is normal, that all the counties and all the cities that they perform audits for, this is who they send their audit reports to is the treasurer, or to that staff. [1:50:05, 1:50:05]: Um [1:50:06, 1:50:10]: My I agree with Councilman Thomas. Yes, we expect [1:50:10, 1:50:18]: to get answers if we ask a question, because we have a right to get those questions answered in order to vote. [1:50:19, 1:50:21]: The way we feel like we need to vote. [1:50:21, 1:50:24]: In order to represent the city and the districts that we live in. [1:50:25, 1:50:33]: However, we don't have a right to demand and tell you what to do if it's not a consensus vote of three people. [1:50:34, 1:50:44]: And I often hear, you know, we'll do the backup and we'll try to, you know, smooth things over or and make it appear a certain way. No, there are two different things here. [1:50:45, 1:50:51]: One, we ask questions to get information and knowledge to make an educated opinion and vote. [1:50:52, 1:50:53]: And two [1:50:53, 1:51:01]: It takes three council members to vote on policies and procedures in order to change something if we don't like it. [1:51:02, 1:51:13]: Not one person. So we can't speak in a demanding way. And I think our staff isn't trying to hide anything. I think we're, I don't want to micromanage. [1:51:13, 1:51:20]: I'm not paid to micromanage. I I don't I don't get the salaries that our staff gets. [1:51:20, 1:51:25]: We need to allow our staff to do their jobs, and if we find [1:51:27, 1:51:28]: At another time. [1:51:29, 1:51:31]: Or we find throughout the course of of [1:51:32, 1:51:34]: of being here that they're not doing their job. [1:51:35, 1:51:36]: Then that's when we take [1:51:37, 1:51:47]: We we make those discussions in executive session, but at at the current time we still allow our staff to do jobs and we rely on the information that they give us. [1:51:49, 1:51:54]: And we base our opinions off of that and the questions that we answer. Again. [1:51:54, 1:51:57]: It takes three to change policies and procedures. [1:51:57, 1:52:01]: Ordinances, resolutions, adoptions, [1:52:01, 1:52:09]: But yes, we we each individual as an individual person ask questions and ask for certain things and that there's nothing wrong with that. [1:52:09, 1:52:11]: I just think that we need to [1:52:11, 1:52:16]: you know, be aware of our staff. The you know, morale is important. [1:52:17, 1:52:30]: And no one here is hiding anything. I don't want you to think that we're hiding anything. And if you believe that we do are, feel free to call and ask us individually or a question or if we don't have the answer, we'll get the answer for you. [1:52:30, 1:52:33]: But no one's here to to hide anything. [1:52:34, 1:52:35]: And that's unfair to our staff. [1:52:37, 1:52:39]: Mayor Tim Berry. [1:52:39, 1:52:51]: Again, Miss Pendergrass, I wanna thank you and Molden and Jenkins and your team for putting together such a great audit. Thank you, sir. And I think what's uh what's missing in the conversation is that the city of Stockbridge has a good audit. [1:52:52, 1:53:12]: Yes, sir. There's been a lot of debate and a lot of conjecture going back and forth. And I think the the thing that's being lost in this conversation is that we have a clear audit. And uh sometimes that needs to be be echoed. I think it's been stated again that we have had certain individuals that had questions and they're gonna be questions. [1:53:12, 1:53:22]: But I also wanna uh also state for the record that the question was answered to the best of her ability about their internal policies and procedures. [1:53:22, 1:53:37]: And so there are two sides to this. There's Malden and Jenkins' procedures, and then there's the City of Stockbridge's procedures. And where those roads connect is where our business starts. And so when those things don't marry each other or don't look like the way we want them to look. [1:53:38, 1:53:43]: That's where this council comes in and we make the decisions on what needs to look like going forward. [1:53:43, 1:54:03]: But for us to have that conversation today with them on what they're presented, I think is a is unfair. I think it's unfair. And if we have anything internally that we need to change, that's for us to decide and not to have that debate amongst our guests as well as those who have presented this information today. So we need to do our own house cleaning. [1:54:03, 1:54:05]: And that's for us. [1:54:06, 1:54:09]: And that's when mine stops. Thank you. Thank you, sir. [1:54:10, 1:54:13]: Ms. Barber, this will be a last comment for you, that is. [1:54:14, 1:54:18]: Yes, I just wanted to make sure I clarify some things. Um [1:54:20, 1:54:29]: I take my responsibility very seriously. Um, last year when I began asking for the independent audit results. [1:54:30, 1:54:34]: It was because our city was considering imposing a city tax. [1:54:35, 1:54:36]: I wanted to see. [1:54:37, 1:54:46]: Not just the financial status of our city with what our staff provides, but what the independent audit says. [1:54:46, 1:54:48]: The same thing for this year. [1:54:49, 1:54:53]: The council approved once again to impose a city tax. [1:54:53, 1:54:55]: Without seeing [1:54:55, 1:54:57]: The results of the independent audit. [1:54:58, 1:55:01]: You said you provided this independent audit. [1:55:01, 1:55:02]: To staff in July. [1:55:03, 1:55:05]: Well we held public hearings regarding. [1:55:06, 1:55:08]: whether to impose a tax. [1:55:09, 1:55:10]: In July. [1:55:11, 1:55:12]: It would have been [1:55:12, 1:55:13]: Great. [1:55:14, 1:55:16]: To receive the independent audit результат. [1:55:17, 1:55:18]: Angela. [1:55:19, 1:55:21]: Before the council approved. [1:55:22, 1:55:37]: The tax. You have something you want to say, Mr. Larry? Yes, ma'am. With all due respect, if you all remember correctly, property tax notice went out from from Henry County and we had to hold our millers rate by law in the dates prior to when Hope said that that this document came out. [1:55:37, 1:55:39]: I just want to make sure that that's clear. [1:55:39, 1:55:43]: Okay. I know that um Mr Gardner, wait, I don't wanna [1:55:44, 1:55:45]: Hold on. [1:55:45, 1:55:46]: Now this [1:55:46, 1:55:50]: I am not trying to point fingers or blame on any one. [1:55:50, 1:55:51]: Mr. Gardner. [1:55:52, 1:55:54]: Step to the microphone, please, and look at me. [1:55:55, 1:55:57]: What I'm trying to do. [1:55:57, 1:55:59]: Is to get my councilmates. [1:55:59, 1:56:01]: To understand [1:56:01, 1:56:03]: Вот вині то іншу. [1:56:04, 1:56:07]: That we are making the best decision for our city. [1:56:08, 1:56:15]: We can't do that if we don't have all of the financial information to back up the decisions that we're making. [1:56:16, 1:56:19]: Which is why I couldn't vote on the millage. [1:56:20, 1:56:21]: I can make any decision. [1:56:22, 1:56:27]: We didn't have the full financials, the ka audit. We didn't have any of that. [1:56:28, 1:56:31]: And to hear her say that she provided the results in July. [1:56:33, 1:56:38]: Амі і майкінводи а специально мети. [1:56:38, 1:56:41]: We could have had it during, you know, one of the public hearings. [1:56:41, 1:56:49]: That is what my thought process has been. Yes, sir. That's not that I'm thinking that you or anyone else is doing anything wrong. [1:56:49, 1:56:53]: Yes, ma'am. When I I've spent ten months [1:56:53, 1:56:55]: Trying to get answers. [1:56:55, 1:56:56]: So I'm a bit frustrated. [1:56:57, 1:57:00]: Фрустрати показ до резиденці. [1:57:00, 1:57:01]: For us. [1:57:01, 1:57:04]: To make decisions that are in the best interest of them. [1:57:04, 1:57:07]: I want to be able to justify the decisions that I make. [1:57:08, 1:57:13]: I can't do that if I don't have all of the supporting documents and all of the information. [1:57:15, 1:57:18]: That's all I want my councilmates to understand. [1:57:19, 1:57:22]: Clearly how important an independent audit is. [1:57:22, 1:57:26]: I don't mind standing alone on an issue. I do not. [1:57:27, 1:57:31]: А вил файт тоді проин. [1:57:31, 1:57:36]: This is a independent audit, should be separate from anything else. [1:57:37, 1:57:38]: That's all. [1:57:39, 1:57:59]: Mr. Alexander Goy, please. Let me just close by saying this. Councilman Tumble, let me just follow up. I I wholeheartedly agree that the answer should be returned every time. We have a right to have that answer being returned every single time. Uh my point earlier was just the process as you was described it. [1:57:59, 1:58:19]: But let me let me make something real clear to everybody. This audit is your audit. It's not my audit. It's not the city manager's audit. It's yours. And our desire is to have the professionals make the decision so nothing political is entered into the process. That's why there is a window between us and [1:58:19, 1:58:39]: In that report. You would not want to think that the audit is being shaded by anything political with the officials getting involved in the numbers. That's why that wall is between us and the numbers, because you don't want the decision to be political. You want the numbers to be clean without free of political process. [1:58:39, 1:58:59]: And I think that's what we have, and I believe and I know that's what we have achieved. So thank you, Ms. Pendegraph. I need a motion to accept the audit, please. So moved. So Mr. Alexander and a second to Mr. Berry. All in favor, please indicate. So you name this decision. Thank you. Thank you, Ms. Penegraph. Look forward to a successful 2025. [1:58:59, 1:59:00]: [7140.9, 7148.5]: All right, the old business. Um what we have here is Streetlight Master Plan presentation. Mr. Aaron, please. [1:59:19, 1:59:39]: Yes, good evening, Mr. Mayor and Council. Evening. Uh tonight we come before you. In your packet, you have a copy of the proposed City of Stockbridge guidelines for street lighting. And one of the things that uh we discussed is about different types of poles in different areas, whether they're gonna be metal pole or wooden poles. And also [1:59:39, 1:59:59]: one of the things this document uh outlines is that in all subdivisions they would be underground so those would have metal poles. So I've asked uh Mr. Joe Cobb with Georgia Power, he's our lighting rep to be present at this meeting so that if you have any questions or concerns, I know one of the [1:59:59, 2:00:19]: projects we were looking at was the Jodico Road next to the bri uh bridges at Jodico about the black metal poles and things of that nature. So I asked Mr. Cobb to come here so he can give you more information as to why in certain areas there are wooden poles and in certain areas there are mud metal poles, if you have any questions. [2:00:20, 2:00:27]: New question for'em. Anybody? You good? anybody? No question on street lights? [2:00:28, 2:00:29]: I think we're good on that. [2:00:29, 2:00:32]: Yes, sir. Yep. Yes sir, go ahead, please. [2:00:32, 2:00:34]: Mr. Aaron, if you would [2:00:35, 2:00:47]: Just reiterate or iterate um costs and who pays. I think uh that just need to be known. I I don't want misinformation to get out. [2:00:47, 2:01:07]: Well, recently we adopted street lighting districts where in neighborhoods and subdivisions that they do have street lights, those uh residents of that neighborhood would pay the street lights for those areas and also on the major thoroughway thoroughfares and street lights and things of that nature, the city pays those street. [2:01:07, 2:01:08]: Street lights. [2:01:09, 2:01:10]: Thank you. [2:01:11, 2:01:19]: If no question, go ahead please. Yes. Um Mr. Aaron and I don't know if this falls under this, but [2:01:19, 2:01:24]: The last meeting you said that you were compiling a list of the areas. [2:01:25, 2:01:30]: including the um newly annexed areas for street lights. [2:01:31, 2:01:35]: You haven't provided that list to the council, and I wanted to make sure. [2:01:35, 2:01:39]: That those newly annexed areas are indeed. [2:01:39, 2:01:40]: On your list. [2:01:40, 2:02:00]: The newly annexed areas, the majority of them were in streetlight districts in Henry County. So those already have streetlights. What we were requested was the major thoroughfares was it was Valley Hill Road, Flippin Road, it was Jodico Road, Walt Stevens Road. Those were the requests. [2:02:00, 2:02:20]: That we had, and we presented that information at that meeting, but it was tabled because Councilman Alexander had some questions about the Jodica Road and whether we could put the black metal poles to put street lights on. And so here we are bringing that information back after we've researched it and had our conference. [2:02:20, 2:02:40]: consultation with Mr. Cobb as to why and why not you cannot put black metal poles everywhere. Because the polls doesn't just have Georgia Power utility on it. They also have other utilities. So I'll let Mr. Cobb speak to that because he did the analysis for the Jodico Road. [2:02:40, 2:02:51]: We have the information. It was presented at the f original meeting, but it was tabled because of the questions about the Jodico Road. [2:02:51, 2:02:52]: Thank you, sir. [2:02:56, 2:03:16]: Sure, I'll try to answer the questions. Thank you for the opportunity to come and uh field those questions for the council here. Um we really have to look at roadways and wood poles versus the metal poles kind of on a case by case basis. And it takes into account, as uh Mr. Aaron stated, whether there are other utilities that are on the poles. [2:03:16, 2:03:23]: such as cable, uh bell maybe on the pole, uh the the backspacing from the back of curb. [2:03:24, 2:03:44]: Can either allow or disallow us to put up a aluminum pole with underground wire for a more decorative, more appealing look. The photometrics, the lighting levels that are required for streets and roads vary based on the traffic and the pedestrian conflict. So we have to run lighting levels. [2:03:44, 2:04:04]: Level studies to make sure that we're providing adequate lighting. Sometimes that can be done from one side of the road. Sometimes you have to involve both sides of the road. And the existing infrastructure that may or may not be there could be overhead or underground, can come into conflict with the type of pole you might prefer. [2:04:04, 2:04:24]: And then you just have to kind of back that all out and see, you know, are you willing to pay the cost for the underground decorative poles versus using the existing infrastructure there with the wood poles? So it's it's just it it really is a case-by-case basis on a road by road that we'd look at on each and every one and then [2:04:24, 2:04:28]: And just mix that with your desire for the appearance of that project. [2:04:29, 2:04:49]: Sir. Okay, please. So I think the the desire is to have the metal poles because we have the metal poles already on the new thoroughfare, which is Chin Parkway. Chin Parkway, which is the new road, the$54 million road project that we have coming through the area. GDOT approved the project. [2:04:49, 2:05:09]: Sure. And from Hudson Bridge Road all the way down to Jonesboro Road, the ones that are between Jodico Road and Mount Olive, they're already there. They're black model poles that are already in that location. Right. The desire was to be consistent with that, and certainly for new development that would come in, we would want them more. [2:05:09, 2:05:29]: decorative look to make sure that it's being consistent with what we have. Because if they are going the extra mile and we're having the developers go the extra mile, we just wanted to be able to do that too. And I would think we want to do that on Walt Stevens. I would think that we want to do that on North Henry Boulevard or all of these major corridors. Uh [2:05:28, 2:05:47]: if possible to do so because it is it is an improvement. Right now we got these polls right now that are look like this versus a great appearance that we would all desire. So certainly I'm supportive of making sure that we do that at every commercial location if possible. [2:05:47, 2:05:57]: Sure. And um the transition from a wood pole with overhead uh utilities, whether it's electric, cable, um [2:05:57, 2:06:16]: Following the case. Let me let me quite clarify. Doesn't have to be e or or you got a metal pole at the r the wooden pole that's already there. Doesn't need to be in conflict. You put the metal pole like we have on the subdivision, we put the poles out front, right uh and run them along uh closer to the right of way so they're not in conflict with what you have on the pole. [2:06:16, 2:06:36]: It it'll again kinda go back to the the spacing behind the road, uh what's available across the street, photometrics. Uh we're more than happy to look at putting in the decorative poles where possible. Um, although, you know, there are gonna be some times where there are conflicts. Right, just like that Jodico location, it's about there's wooden poles there, they're about they're really about [2:06:36, 2:06:56]: About 75 feet off the road. Correct. So we there's plenty of space to go into the right-of-way. And certainly Walt Stevens has a long uh right-of-way as well. And certainly we want to do things as best that we possibly can. So I'm supportive of this particular program and making sure that we get uh the best as possible. [2:06:56, 2:07:11]: And then it also applied us, it allowed subdivisions who don't have enough lighting in there already to go back at their cost, Mr. Aaron, right, and to add additional street lights in their subdivision because there'll be special service districts, correct? [2:07:13, 2:07:33]: Yes, sir. And also but but keep in mind, even though on some major thoroughfares you do the black decorative poles doesn't necessarily mean the wooden poles go away. No. You're just gonna add additional and then you're gonna have that clutter where you got, okay, if I already got twenty wooden poles and you're trying to put black stuff. [2:07:33, 2:07:53]: street light poles, then you put on another twenty black street light poles. So now you got forty instead of the twenty. So I I certainly understand that. I don't think it'd be necessary to put twenty. I think we go. We what what they did over there at uh at the on the existing roadway is beautiful. They're separated quite a bit. [2:07:53, 2:08:13]: They're not right next to each other. I think between the w original road that's in there, Jodeco, and the first turn, there might be like two. So it's not like a lot of lighting because they're high intensity lights. So again, I'm supportive of this program and doing what's necessary. So I would make a motion to support this if [2:08:13, 2:08:26]: Yeah, I do. I have one one um more question. And and I know this probably doesn't have anything to do with [2:08:26, 2:08:30]: So the lights around the amphitheater um as [2:08:31, 2:08:35]: Did you use this program here for it? [2:08:36, 2:08:44]: No, the lights around the amphitheater was a part of the amphitheater development. So it had it on its own lighting plan. It was separate from this. [2:08:44, 2:08:47]: Okay. I'm asking only because it seems [2:08:50, 2:08:53]: I got my Georgia Power Bill last week. [2:08:54, 2:08:55]: Um it was [2:08:56, 2:08:57]: Excessive. [2:08:57, 2:09:02]: But nonetheless, I'm just thinking in terms of how we can reduce costs. Um [2:09:02, 2:09:05]: And I certainly don't want to hold up the progress. Um [2:09:06, 2:09:10]: You can work with містер Алекскаунсман Александр он Джотико Род. [2:09:11, 2:09:14]: And whatever he'd like to see, but I certainly want us to move forward. [2:09:14, 2:09:19]: Um, with Valley Hill Road and those other NX areas as you originally presented. [2:09:20, 2:09:21]: But I still wanted to [2:09:21, 2:09:25]: ask about the um lighting around the amphitheater, it seems like [2:09:25, 2:09:27]: It's a lot of lights. [2:09:27, 2:09:30]: And they're only used on the weekends, mostly. [2:09:33, 2:09:38]: But it has nothing to do with this. So I'll talk to you offline about my concerns, Mr. Erin. [2:09:40, 2:09:41]: Mr. Barrett, go away, please. [2:09:41, 2:10:01]: Yes. Mr. Aaron, just from our earlier conversations, I just wanted I know we are on the project and those areas have been already identified and highlighted, but for the for a point of clarity, can you express to the people for record, for those who are not on this particular plan who may be in not in a subdivision or maybe on their own private role like the banks drive and other [2:10:01, 2:10:06]: the neighborhoods that may be like that that would like to get street lights, what that procedure for them looks like. [2:10:06, 2:10:23]: So if I know we've received some calls from the residents on Banks Drive. And one of the things is it outlines the process and how you go about requesting street lights. It's kind of similar to the petition for uh speed humps. [2:10:23, 2:10:28]: I think it's like fifty one p percent or so of the residents. [2:10:28, 2:10:34]: in that neighborhood or subdivision would have to agree to pay the assessment before the street lights are installed. [2:10:36, 2:10:56]: I'd have to go back and look specifically. I know it's a majority of the residents have to agree to pay the assessment. When Georgia Power comes out, they give us a cost. They'll say it's 13 lights and it costs X amount. So that's divided up among the residents in the neighborhood, and they have to agree to pay the assessment. [2:10:56, 2:10:59]: before the city wouldn't have the lights installed. [2:11:00, 2:11:11]: All right, thank you, sir. Mr. Addison, go ahead with your motion. All right, we'll say this to Mayor Pro Timberry, you got lucky, Rock Corey gonna have those metal. So you good. I'll make a motion to approve the pro program. [2:11:11, 2:11:12]: Is there a second? [2:11:13, 2:11:18]: Mr. Barrett, second, in all favour, please indicate the decision. Thank you, gentlemen. Thank you very much. [2:11:19, 2:11:39]: What we're gonna go on next is our public hearing. And obviously, I'll read the public hearing rules. And the first item for public hearing will actually be a continuance of a previous public hearing we had uh last month. But let me read these public hearing rules. Please mute all your cell phones, all uh electrical devices. If not I can email it to you all right now. But you all have it. [2:14:18, 2:14:27]: Well we've received I don't have it handy f right in front of me and I don't know if the rest of the council has it handy in that aspect at all either. If not I if not I can email a separate copy. I'll do that for you all. [2:14:27, 2:14:28]: No. [2:14:28, 2:14:29]: Okay. [2:14:30, 2:14:31]: Ms. Anza, please. [2:14:32, 2:14:34]: Okay, good evening, Mayor. Um [2:14:36, 2:14:45]: We need to resume um this um public hearing um on August twelfth, um at the last meeting um uh [2:14:46, 2:14:49]: We had h we heard the uh public comments from all the citizens. [2:14:49, 2:14:51]: And uh staff report. [2:14:52, 2:14:52]: And um [2:14:53, 2:14:55]: And we also heard from the applicant. [2:14:55, 2:14:58]: Uh council was deliberating and council. [2:14:58, 2:15:01]: made some requests of the uh applicant [2:15:01, 2:15:04]: And the applicant went back and uh addressed those [2:15:05, 2:15:05]: Concerns. [2:15:06, 2:15:09]: And uh they uh they sent the email address to council member Alexander on [2:15:10, 2:15:16]: August the twenty seventh, addressing those um those concerns and explaining to the council how they handle those issues. [2:15:17, 2:15:37]: So on that note, um I would imagine the applicant uh excuse me not the applicant, the individuals that are actually uh selling the property, we did want some questions and concerns and and have the have a conversation with them. I'm assuming uh that uh they are present to answer any questions that the council may have. Yes, sir, they're present. Yeah, come forward please. All right. [2:15:44, 2:15:45]: Yes, sir. [2:15:46, 2:16:02]: Of course. For that for recording, I'll give it to Mr. Thomas here for his questions, sir. Shorts. Uh John Jordan, um with Hector Walker Jordan, two hundred five, Corporate Center Drive, sweep B. Stockbridge Georgia, three hundred two eighty one. [2:16:03, 2:16:04]: Any any lady here? [2:16:05, 2:16:13]: Ruby Anna Whitworth, eighty-nine Braymore, Mills Drive, Lawrenceville, Georgia, zip code three hundred forty-four. All right. Go ahead, Mr. Thomas. [2:16:13, 2:16:33]: I wanna thank you all for being here. Um basically wanna follow up from the last meeting. There were some concerns about the tenants being able to actually find or move or find residency in a in a time. [2:16:33, 2:16:38]: So can you give us an update or all of the tenants uh out? [2:16:39, 2:16:40]: As of today. [2:16:41, 2:17:01]: Uh the tenants are not out as of today. They were given a ninety day notice instead of a thirty day notice uh a couple of weeks ago. Um so they're in the process of making arrangements for that. And actually uh Miss Rubiana is here with us today. She is the operational the division operations director for Georgia and Alabama and [2:17:00, 2:17:19]: um she's prepared a little uh presentation for thank you for that. Let me j I'm gonna finish this and then you can respond. I think it was nineteen um individuals that was there at our last meeting. That's my recollection. And I believe Miss Rubiana can probably [2:17:19, 2:17:22]: Yes, right now we have fourteen residents still there. [2:17:22, 2:17:24]: Okay, so [2:17:24, 2:17:30]: Can you get into the process and and the timeline that they would be allowed to [2:17:30, 2:17:41]: uh to f you know, relocate and what assistance, if any, that y'all are giving to to assist them in finding uh uh a a place. [2:17:41, 2:18:01]: Sure. So we did provide them with a 90-day notice, not only the residents, but the staff as well. We have contacted the uh neighboring assisted livings in the area to let them know that we will be closing so that they can come in, talk to the residents, complete assessments so that if they need to relocate, they can do so. [2:18:01, 2:18:21]: Also, a part of our company, we have two other sister properties in the Georgia market. Um, the closest one being Smyrna, Georgia. So we did host the residents as of last Friday so that they could come and tour the facility so they could make a decision on whether or not they would like to stay with the same company. And with that, we would be able to honor their [2:18:21, 2:18:23]: same rate if they decided to transfer. [2:18:24, 2:18:28]: Same rate, that is great. So when you say ninety days, ninety days from [2:18:29, 2:18:33]: Nine days from um August the nineteenth. [2:18:34, 2:18:37]: Okay. Thank you, Mayor. I yield back. Mr. Alexander. [2:18:38, 2:18:58]: Yes, uh I certainly appreciate it um that you are endeavoring to work with the residents in um in a compassionate way. Um and to be able to make this transition uh as less painful as possible uh for the existing residents there. So it's since the time of [2:18:58, 2:19:18]: of our last meeting, uh about five residents have relocated, which you're indicating, and you're indicating that you would go along and you would also them the same rate at a s at the sister or brother uh facility so that the financial impact wouldn't be uh as would be minimized. [2:19:18, 2:19:25]: That's correct. Okay. So uh is there anything else that you would like us to know uh about this particular process? [2:19:26, 2:19:46]: Um uh outside of the residents, we do have our valued employees and we are working alongside them to ensure that they do have a smooth transition as well. Um I'm thrilled to announce that out of the two employees that I've been working closely with, um business office manager and resident care coordinator, we have been able to offer them transitions. [2:19:46, 2:20:01]: I do plan to work with them closely as far as our frontline staff. If they need letters of recommendation, we're happy to do that, as well as host resume workshops so that if they need resumes put together to get out into the workforce, we're happy to do that too. [2:20:02, 2:20:22]: Okay. Thank you so much. I appreciate that. Any council, any other questions for them right now? Anybody else? Okay, so uh Mr. Anderson, uh the the individual that plans to upon whatever decision council comes plans to actually make the uh produce the boutique hotel and I imagine she's present, would uh like to see if she wants to come forward or come forward any questions. [2:20:22, 2:20:24]: that the council may have for this time. [2:20:29, 2:20:34]: Yes, I'm here. My name is Vena Skirvin at two seven zero Prairie View Place, Atlanta, Georgia, three oh three one one. [2:20:34, 2:20:54]: Thank you for your patience. Council, any questions for all? Yes. Ms. Thank you so much for coming back and uh wanting to bring uh uh a new business to uh the city. Uh you I just want to make sure that so everybody understands here everything that has been stated here, you are in agreement with the time. [2:20:54, 2:21:01]: table in the transition on the resident and the compassionate process that the council has required. You are in agreement with that. [2:21:01, 2:21:02]: Uh yes, I have no objections. [2:21:03, 2:21:15]: Okay, talk about um as this moves through and then uh maybe Mr. Jordan or someone could talk about again just kinda a little bit briefly to talk about the project that you're hoping to bring. [2:21:18, 2:21:34]: Uh well I'm hoping to bring a uh upper upscale boutique hotel um to the facility. I'd like to um renovate it. I'm thinking about a six to nine month renovation process uh before we'd be able to um you know have an opening date. Um the [2:21:34, 2:21:53]: uh hotel would be uh soft branded. Um we're looking at uh either Hilton or um Hyatt or an IHG or a Wendham um soft branded property. Um and we're just you know looking forward to uh being able to um you know execute this process. [2:21:53, 2:21:56]: All right. Thank you so much. Any other questions, Council? [2:21:57, 2:22:05]: If if not, okay, thank you. Appreciate it. All right, ladies and gentlemen, this is open uh a public hearing. You can have a seat, please. I'm sorry, Mr. Go ahead, Ms. Sampson. [2:22:06, 2:22:11]: I I don't need more well my make I wanna make sure I I'm brought proper here. Attorney. [2:22:14, 2:22:21]: Okay, now Dom I need to open up for any public comments at all? If we we reconvene this or continu you know, we didn't end it. [2:22:29, 2:22:34]: Okay, well I did close out public comments at that time. I did. Okay. All right. Thank you. All right. All right. No pro [2:22:37, 2:22:57]: All right, understand. Got it. So on that that note, then actually I just need a motion to to accept this uh proposal for this to to go forward. Uh mayor, I would like to make a motion to approve uh what we have described here uh with this transition with the approved ninety days as we have already. [2:22:57, 2:23:17]: Already outlined in the put in this process to transition. I think we had discussed some additional conditions such as lighting along the frontage of the property and as well for us to be able to do that, and then flock cameras at the entryway for security. [2:23:17, 2:23:34]: security and purposes. And you had also enumerated that the uh gate would actually be a functional gate uh at this point. The gate now is left open all the time, but it would be required that that gate would be functional uh for uh for entry to the property. [2:23:36, 2:23:55]: Um yes and I'd request it that that be uh at night time. Right. Yes. Absolutely. My motion that's that'll be my motion for approval. Is there a second to motion? Second. Mr. Barrett, second. All favor please indicate. Congratulations, everybody. Fantastic. Thank you. Thank you. We'll move on. [2:23:57, 2:24:17]: Okay, so what's next? The proposed development would also include six parking spaces for visitors and 19 parking spaces close to the pool. The proposed townhome development will include a 25-foot buffer along the eastern bank. [2:31:28, 2:31:40]: boundary line adjacent to the lakeside at Eagles Landing Subdivision. In addition, the prop the proposed of proposed development will be gated and will include a five foot sidewalk on both sides of the internal streets. [2:31:41, 2:31:43]: The proposed town home development will utilize the existing [2:31:44, 2:31:55]: Acceleration lane located on Highway 42 North, and we'll install an emergency access road on Highway 42 North. In addition, the proposed townhome development will have main access from Park Place Subdivision. [2:32:02, 2:32:07]: Here's a um a copy of the um the site plan and the layout. [2:32:14, 2:32:19]: Here's a rendering of the um of the townhomes. You see they have full brick facade. [2:32:24, 2:32:27]: Here's another photo of the uh of the elevation. [2:32:31, 2:32:45]: So as it relates to the um the comp plan, staff' uh recommended approval of the change from low density mixed use to medium density residential. Now I proceed to the uh rezoning. [2:32:49, 2:32:52]: Here's a picture picture of the city of Stockbridge future land use map. [2:32:59, 2:33:19]: Here's the density of the surrounding properties that surround the proposed development. You got to the north, you got low density mixed use. To the south, you got low density mixed use. To the east, you got low density mixed use and high density mixed use. And to the west, you got high density residential, low density mixed use, low density. [2:33:19, 2:33:21]: low density mix use and low density mix use. [2:33:23, 2:33:43]: The high density residential to the west makes the um the proposed development compatible with the surrounding community. As you can see, here's the density of the surrounding um developments, existing developments. At Brandon's Walk, you got forty-six units at four units per acre. You got Lakeside at Eagles Landing, which has 90 units, which [2:33:43, 2:33:53]: three units per acre. You got Parkside at Eagles Landing with 240 214 units with three units per acre. And this proposed development will have seven units per acre. [2:33:56, 2:34:02]: Here's the surrounding land use densities map. This is just a map of what I just previously mentioned. [2:34:05, 2:34:15]: And uh the proposal is the um consistent with the city of Stockbridge comprehensive plan. So as it relates to the rezoning, staff recommends approval as that also on that one. [2:34:24, 2:34:32]: So the variance, the applicant is requesting two variants, a variance to reduce the front yard setback of the townhome lots from the required fifty feet to thirty feet. [2:34:33, 2:34:37]: And variance request number two, reduce the side yard setback to the town home lots. [2:34:37, 2:34:40]: between buildings from the required fifteen feet to ten feet. [2:34:40, 2:35:00]: We were we were m excuse me sir. We rem the thirty feet was already changed, right? Uh we did a presentation on that, but we got to actually bring that back before council n uh at the next uh city council meeting for adoption. We presented it to um you guys as a presentation to get your input before we move forward to the planning commission. Okay, so we have to put in the conditions. [2:35:00, 2:35:20]: Yes, but we we are recommending a thirty-foot front yard setback on townhomes. Uh the industry standard is around twenty-five feet. But we think uh thirty feet would be best for the city of Stockbridge. Yes. Um so as a result um of the proposal that we currently have in process, uh staff [2:35:20, 2:35:21]: recommend approval. [2:35:21, 2:35:22]: For the required [2:35:23, 2:35:26]: Uh reduction in the front yard setback from fifty feet to thirty feet. [2:35:27, 2:35:29]: And also um variance number two. [2:35:29, 2:35:47]: Because this would be such a high quality um development, uh, with the full brick facade and everything, staff didn't feel like it would be detrimental to the community to reduce the required side yard set back from fifteen feet to ten. So staff recommended approval for both for both variances and that completes my report. [2:35:48, 2:35:52]: All right, council questions do you have for Mr. Anderson? Um go ahead please. [2:35:53, 2:35:56]: Miss Anderson, uh so it's all brick? It's on all [2:35:56, 2:35:59]: Uh no the the facade, the front elevation is all brick. [2:36:00, 2:36:02]: They will have a heart um hardy plank on the side. [2:36:02, 2:36:03]: Okay. [2:36:04, 2:36:18]: We'll we'll we'll talk about as we talk about the the the uh there are variations for uh the conditions. They'll present that when the when the applicant presents. Yeah, we uh oh yeah some c conditions as associated with the rezoning. I need to go back and pr and read into the record. [2:36:30, 2:36:48]: It's gonna be fifty percent and fifty percent like the other one. Okay, um fifty and fifty. For the for the rezoning um approval, st staff did recommend uh several conditions. Number one, flock cameras will be located at the entrance of the proposed town home development. [2:36:48, 2:36:56]: A twenty five foot buffer shall be established along the northern and southern portion of the subject property. A mandatory HOA shall be established along the [2:36:57, 2:36:59]: The units shall not exceed one hundred units. [2:37:00, 2:37:03]: The rental shall not exceed ten percent of the proposed town home development. [2:37:04, 2:37:06]: A male kiosk shall be established. [2:37:06, 2:37:08]: The rendering shown with the submitted [2:37:08, 2:37:28]: Application on July first, 2024 shall be followed. The brick is shown on the front and on the side is showing hardy hardy plank siding. But these are um similar to the most of these conditions come from our proposal that we have on the way for the um the revamping of the MFR standards. So they're pretty standard for us. [2:37:28, 2:37:29]: No. [2:37:31, 2:37:32]: Okay, any more questions, Ms. Gantt? [2:37:33, 2:37:33]: No. [2:37:33, 2:37:35]: All right, Miss Barber, go ahead, please. [2:37:35, 2:37:36]: Yes, thank you. [2:37:38, 2:37:41]: I live in Lakeside, subdivision. [2:37:42, 2:37:53]: Is there any homeowners in Lake's high okay um you live behind where this proposed development will be? Please please please address Ms. Darrison, please. Um [2:37:53, 2:38:02]: I live in Lakeside Subdivision. Lakeside is divided by East Lake Parkway. I only represent the side. [2:38:02, 2:38:03]: The other side. [2:38:05, 2:38:12]: Councilman Alexander represents the other side of my subdivision. It's the way the council drew the district lines intentionally. [2:38:13, 2:38:14]: Nonetheless. [2:38:15, 2:38:15]: Um [2:38:16, 2:38:17]: I did get out in the community. [2:38:18, 2:38:21]: Um Lakeside and Parkside on Saturday. [2:38:21, 2:38:23]: And I posted notice. [2:38:24, 2:38:25]: on mailboxes. [2:38:26, 2:38:31]: to make sure that the homeowners knew that this development proposal was gonna be presented today. [2:38:32, 2:38:32]: Um [2:38:33, 2:38:33]: Well [2:38:35, 2:38:39]: I understand the developer, the landowner has a right. [2:38:39, 2:38:40]: They have a right to sell their property. [2:38:41, 2:38:44]: And the developer has a right to submit an application to build. [2:38:45, 2:38:46]: Is whether or not [2:38:46, 2:38:48]: What they propose to be [2:38:49, 2:38:51]: is something that meets our [2:38:52, 2:38:54]: cities building standards and codes. [2:38:55, 2:38:58]: The developer has submitted some [2:38:58, 2:39:01]: Exceptions is what I like to call them. [2:39:01, 2:39:02]: The variances. [2:39:03, 2:39:05]: And amendments. There are exceptions. [2:39:06, 2:39:07]: To our code. [2:39:08, 2:39:09]: Far too often. [2:39:09, 2:39:10]: Proposals are being sent. [2:39:11, 2:39:16]: And the council is approving, amending our comprehensive plan. [2:39:16, 2:39:18]: And approving the rezonings. [2:39:19, 2:39:24]: So I've asked the question why spend hundreds of thousands of dollars? [2:39:25, 2:39:29]: On a comprehensive plan or unified development code if we keep amending it. [2:39:30, 2:39:32]: Every time someone submits an application. [2:39:32, 2:39:35]: But perhaps that's the ways of developing. [2:39:37, 2:39:40]: Nonetheless, um, this is close to where I live. [2:39:42, 2:39:44]: So absolutely, I have a vested interest. [2:39:44, 2:39:46]: in this particular development. [2:39:47, 2:39:52]: I'd like to see some concep conceptuals of this that hasn't been provided. [2:39:53, 2:39:58]: You mean renderings? Or or renderings, you have some I showed you some renderings. Let me show let me go back to that screen. [2:40:01, 2:40:01]: Okay. [2:40:02, 2:40:04]: This is the first time I've seen them. [2:40:04, 2:40:05]: Okay. [2:40:06, 2:40:08]: And here's another angle. [2:40:08, 2:40:11]: A four brick facade. [2:40:11, 2:40:17]: Thank you. They do look nice. I did have an opportunity to talk with um [2:40:18, 2:40:21]: I don't know if he was the developer. Mr Moore, is he here? [2:40:22, 2:40:23]: Uh yes, they're here. [2:40:24, 2:40:27]: I did have an opportunity to talk with him on Friday. I shared with him. [2:40:27, 2:40:31]: Some of my concerns, safety concerns. Um [2:40:31, 2:40:32]: The [2:40:33, 2:40:36]: Entry and exit points. We're not at that point yet. [2:40:37, 2:40:44]: I mean you I'm I'm complete with my uh entire presentation, so you can ask a question on that. Okay. Then I'll wait. Okay. Thank you. All right. [2:40:45, 2:40:57]: The applicant can come up oh if you have any questions. Yeah, come on up please. Um Mr. Sam, do you have some questions there? Yeah, let the applicant make the presentation as customary. Okay. [2:41:00, 2:41:01]: Thank you. [2:41:04, 2:41:05]: All right. [2:41:06, 2:41:10]: Good evening, Mr. Chairman. Board members. Evening to you, sir. [2:41:10, 2:41:30]: Welcome. Thank you. George Harper, Paramount Engineering, 11 East Broad Street, Noonan, Georgia. Thank you for hearing us tonight. So, yes, these are just to kind of start off and answer your questions about the renderings. Now, these were the same renderings that were submitted with the uh the original package. They were in the planning commission and these were showed at the original. [2:41:30, 2:41:50]: Original Planning Commission meeting that were approved. So I maybe there was a little confusion there. I apologize. I do have uh I did send some additional ones in today. Really, it was just for a three-story unit that we're proposing as well. And then I provided a little bit of uh additional information on some interior pictures, that type stuff. So that's really the [2:41:50, 2:42:09]: the only additional information that I sent in today that that wasn't in the original package. So if if that helps a little bit. So um do you want me to go through the presentation ways, sir? If you have a presentation, I didn't know if he was quite finished with with his or not, but uh give me just a second I can [2:42:09, 2:42:15]: Ryan, he may need some help with this just in case uh maybe give him some of this assistance to get this thing up. Yes, sir, if you don't mind. [2:42:19, 2:42:20]: Uh how we point to. [2:42:22, 2:42:42]: You got the new three-story. It's okay. Yeah. Thank you. Okay, here we go. All righty. So um again, my name is George Harper, Caraman Engineering. I'm representing LI Route 23 today. So this property is owned by the Clark family. Uh Clark family has owned C and C fence for a number of years. Uh this [2:42:42, 2:43:02]: property uh they wanted to uh expand their fence company a few years ago and they came before the city to try to have it rezoned to I believe it was LI so they could expand uh again their fence company and and that was denied. And so they've been sitting on the property for a number of years and just haven't really had any opportunities to sell it at [2:43:02, 2:43:22]: At the current zoning, uh no interest in the C2. So uh my uh my clients came along and offered to um try to buy the property and develop it as obviously a residential uh townhome development. Um starting off, I'll kind of go through just kind of like his presentation as far as the comp plan. So obviously. [2:43:22, 2:43:36]: Obviously we're um we're recommending that uh or asking that it be uh changed from low density mixed use to the MFR. Um we do meet the MFR um the medium density residential uh density requirements. [2:43:36, 2:43:56]: We're uh asking for 7.35 units per acre, which is less than the 7.99 that are uh is the max in a medium Disney res uh medium density uh zoning. Uh we're asking to rezone from C2 to MFR. Um the variances, uh I can go through those as well. Um [2:43:56, 2:44:16]: And I'll give you a little explanation of why we're asking for those variances. So the front setback, I think kind of maybe the staff has has presented some additional information to you guys. Um and it kind of goes along with what we were asking for from the 50 to the 30. If you think back uh on most townhome developments you've been in, most of the [2:44:16, 2:44:36]: people that live in those are younger families or maybe some some older families as well. They don't want a whole lot of yard maintenance. So we try to pull the the units closer to the road a little bit. Uh obviously have enough room between the sidewalk and the front of the house to have a car in the driveway, but not have just a ton of maintenance. So that's kind of the the theory behind the uh [2:44:36, 2:44:56]: Reducing the front setbacks. The side setback. Do you have any other slides besides this one? I do. I I'll get to those in just a second. I'm sorry. Yeah. Go right in, please. I apologize. Thank you. So the side setback. So this one, the the city ordinance says that the minimum side setback is 15 feet, but [2:44:56, 2:45:00]: the minimum distance between houses [2:45:00, 2:45:18]: is twenty feet. So that would be ten on each side. So all we're trying to do is make our get a variance to make it meet that requirement of the of the ordinance. So if you otherwise it would be thirty feet between units. So we're trying to bring it down to meet [2:45:18, 2:45:23]: The minimum distance between buildings of twenty feet, and that's a that's a typical fire code as well. [2:45:23, 2:45:43]: So that was our that was our premise behind uh requesting that uh variance as well. As far as our open space goes, um, you know, we more than meet the open space requirements. Uh we gotta have a minimum of two point oh four acres, we have two point eight one. Um this uh property, if it was to be developed. [2:45:43, 2:46:03]: to its maximum density and meet, for instance, the I believe it's parkside, which is across the street from us there, which is high density, we could get up to 162 units on this property. If we were to go for a high density, we chose not to do that. And you can tell by looking [2:46:03, 2:46:23]: at the plan here. You know, we do we did try to reserve a a decent amount of open space, you know, kind of in between the units and along the frontage out there to give a little buffer along Highway 42, but also to design it to where you're not the back of your house is not just butted up against another another unit. [2:46:23, 2:46:32]: to give a little bit more room, a little more privacy. And so that was kind of our thought to reduce some of the units um and make it just a little bit uh higher quality product. [2:46:33, 2:46:47]: Uh we've got plenty of amenities in this project, uh pool with cabana, playgrounds, um some additional guest parking. We're gonna do a real nice decorative um kind of the black wrought iron type uh fencing along the front. [2:46:47, 2:47:07]: Uh we've got a second entry in the back. It's gonna be an emergency entrance. Actually that driveway is is uh currently installed as well. So um that's gonna be just kind of a uh secondary fire access. It will be not there will be no m major traffic through there. Um we have two car garages on all of our units. [2:47:07, 2:47:25]: We're not doing any one-car garages. They'll all be two to three-story. We started off with just a two-story product, and the more we got to talking, we we kind of decided that uh we we're gonna go to a three-store unit and I'll show you some renderings of those in just a second. [2:47:26, 2:47:35]: Um but we are surrounded by, you know, a lot of single family, but the densities are pretty you know pretty comparable to those to those units. Um [2:47:37, 2:47:53]: All the units will be uh at least eighteen hundred square feet. They'll probably go up to even twenty three hundred on some of the the uh three storey units. Uh they'll be constructed with mostly brick, stone and stucco. Uh the remainders of the so the the front of the house will be all be brick, stone, and stucco. [2:47:54, 2:48:14]: The sides and the rears will be a mix of shakes, board and batten, and some concrete hardy boards. Now we also are going to do at least an eight foot high uh masonry water table around the unit. So if we know what the water water table is, so basically the first almost the first floor of each unit. [2:48:14, 2:48:34]: Will be uh brick, stone, or stucco. Okay. Um, and then above that would be the Hardy or the Shakespeare or the batten board. Um they'll have uh real nice decorative garage doors, front doors on all the units. Again, like I said, two car garages. The and if you look through here, let me go down. [2:48:34, 2:48:39]: Okay. This is one of the renderings that I showed before. [2:48:40, 2:49:00]: I wasn't able to kind of change the picture of this, but I do want to stipulate in in the minutes that the little overhangs above the garage, and you'll see on some of our other units. Here we go. Here's one of our three-story units. So the little overhangs over the front doors and the in the center windows, we're going to do the like the metal roof. [2:49:00, 2:49:06]: on those instead of instead of shingles. So it it makes a much much nicer product. [2:49:07, 2:49:17]: kind of flip through here. So these are these are some of the uh renderings uh and just samples of of kind of what the interior of the units will look like. You can tell they're [2:49:17, 2:49:37]: Uh they're very nicely appointed, lots of windows, um solid surface countertops, um trim moling, you know, very modern, updated type uh units. These are a lot of the same products that are being built, you know, all in Atlanta, um, and we really feel [2:49:37, 2:49:56]: like this will cater to um a lot maybe more of a younger working type crowd um in this area especially uh how close it is to the uh interstate and you know all the amenities around I mean you can walk to the the restaurants um [2:49:57, 2:50:16]: and everything else around you. So it's it's in a great location. Um and we really, really are proud of these uh these interiors that we're proposing. So again, this is the three-story unit that we just recently added today. Again, this this was really the only rendering of the outside that I added today that wasn't in the original presentation. [2:50:17, 2:50:19]: Anyway, so there's some more of those [2:50:20, 2:50:21]: Those uh renderings. [2:50:22, 2:50:34]: So we'll have mandatory homeowners association that'll include the lawn service, garbage collection, uh with community mailbox. Again, you saw the on the rendering there, we've got uh a pool with a pool cabana. [2:50:34, 2:50:36]: Um restrooms. [2:50:36, 2:50:40]: And fire pit, playground. So we we really tried to [2:50:40, 2:51:00]: We really envision this as a as a kind of an upscale type of townhome development in this area, it being so centrally located, close to Eagles Landing, uh it's really got a lot going for it. So I'll answer any questions or I'd like to reserve the few seconds I got left for rebuttal. Got uh Mr. Azankoy, please. [2:51:00, 2:51:20]: Yeah, thank you so much. I appreciate uh the presentation and to some Miss Gantt can breathe over here. They're not gonna be all 100% brick. Uh I think we had discussed uh that we would have uh fifty percent of them be a hundred percent brick, and then there would be some flexibility uh on the other fifty percent that would be left to the homeowner. [2:51:20, 2:51:40]: Consistent with what we did with Brandon Row. So the homeowners could have some options on what they want to do with the facades. We certainly also discussed three-size brick. So the size of the unit would be brick, and then the water table would be on the rear of the unit so that we would have some. [2:51:40, 2:52:00]: consistency as far as that is concerned. So there were some additional conditions. Uh of course the can you've already read the it's a gated community, flock cameras at the entrances, at the entrances. There would be a 10-foot multi-use path along highway 4223 with six [2:52:00, 2:52:20]: foot sidewalks uh inside, not five foot, six foot sidewalks inside. Uh the staff described the acceleration lane that would be there if council did so desire. And then you described the minimum square footage which is 1800 square feet. We want them to be not basic townhomes, which you have described are really [2:52:20, 2:52:24]: [10344.2, 10364.2]: a town home where when you walk inside that door, you did not know that you were in a town home. The only distinguishable difference would be when you walk out the door, you wouldn't have a large yard, and these yards are going to be taken care of for the uh rock and go living as you had indicated, if council was so desired. [2:52:44, 2:53:04]: uh for that to be. Uh we talked about that a clubhouse, a pool, a cover pavilion, and also an outdoor grill area was agreed upon with a fire pit and then uh the black metal decorative street lights uh would go along uh the frontage along highway 42 uh [2:53:04, 2:53:24]: if that was so desired. And uh the acceleration lane, if it were possible, and you you have to go to GDOT to see whether it's possible or not to try to connect it to that turn lane uh at East Lake and whether they would allow you to do that or not because they're gonna widen Highway 42 eventually. They might even give you the funds to do it. [2:53:24, 2:53:44]: with like they did at Jodico, they advanced the funds so that that could be done. So the acceleration lane that you're going to be putting in, you would check with GDOT and staff would work through the process in order to see whether or not you could connect that acceleration lane with the turn lane so those residents when they were coming out would not have to fight with those two lanes of traffic. [2:53:44, 2:54:04]: They would just have a uh an automatic out right there, which would be adding a lane if council so uh desired in order to uh approve this. But looks like a really, really good product. And again, um I think you mentioned that the three-story unit uh is something that is completely lacking uh from this. [2:54:03, 2:54:23]: community. I can tell you that those items are something that's highly desirable for the community. So thank you for bringing a three-story model ahead. And again that will give us the square footage that will actually be bigger than the homes, uh most of some a a lot of the homes that are surrounding uh these particular town homes. [2:54:23, 2:54:30]: So thank you. Yes sir. Questions council. Anybody? Miss Barber, go ahead, please. Yes. [2:54:30, 2:54:36]: Okay. So the entrance and exit points. That's what I wanna [2:54:36, 2:54:39]: Yes. [2:54:40, 2:54:41]: Access point. [2:54:41, 2:54:42]: And one [2:54:43, 2:54:56]: Exit. Yes, ma'am. And it yes ma'am. It lines right up with that parkside drive right across the street. And that that is actually existing at this time. Okay. Now we have a secondary emergency access. [2:54:57, 2:55:08]: Okay, so if you look and it's kind of hard to see on this drawing, but the very co uh last cul de sac here that that um is on the very southwest corner, if you look on the plan. [2:55:08, 2:55:24]: There's actually another existing curb cut on Highway 42 there. And so we're going to use that as a secondary uh fire access, just emergency. It'll be gated off to where, you know, people are not coming in and out. It'll have a knox box on it. And um [2:55:25, 2:55:34]: You know, so it's a secondary emergency access. Yes, ma'am. Okay, so this is gated. When I spoke with the gentleman on Friday, Mr. Moore, he said it was not gonna be gated. [2:55:35, 2:55:55]: We've kind of been back and forth on some of that. It's still uh honestly, we're a little unclear um if we can do gated gates on a public street. And we're still we kind of worked we've asked that question with staff. We had I don't know we've gotten kind of a a definitive answer yet. We would like to gate it, but we also need to do these things these are [2:55:55, 2:56:03]: Going to be public streets. You know, we do have right-of-ways shown that will be dedicated to the city. Um, and so we're kind of working through that issue. Um [2:56:05, 2:56:17]: So I'm saying if you ask our staff and w our staff can't be able to do that. Seems like that. [2:56:18, 2:56:28]: As far as I I I know, Mayor Ford, um it can't be gated on a um on a public street. It has it has to be non gated. But w if the streets remain private, he can put a gate up. [2:56:28, 2:56:30]: Okay, thank you. Go ahead, proceed. [2:56:30, 2:56:32]: Uh no no, you're fine, Mr. Anson. Proceed. [2:56:33, 2:56:34]: Ms. uh M Barber. [2:56:34, 2:56:37]: My next question is regarding the traffic study. [2:56:38, 2:56:38]: Um [2:56:40, 2:56:44]: When was that conducted? Uh there wasn't one done. Um it was not required. [2:56:44, 2:56:49]: It wasn't required. Okay, that area is heavily traveled. [2:56:49, 2:56:52]: Um and I can only imagine. [2:56:52, 2:56:58]: Um those who may be exiting this development and trying to turn left. [2:56:59, 2:57:00]: Yes, I'm listening. Um [2:57:02, 2:57:04]: Uh there are safety concerns there. [2:57:06, 2:57:17]: Yes, ma'am. Uh if in the staff's report that they did originally, uh they did some traffic analysis uh on that. Take me just a second here to find it. I apologize. [2:57:19, 2:57:33]: It uh the uh average daily traffic on highway forty two was like seventeen thousand something cars per day. See, I know that's just and we were only expected to generate uh [2:57:35, 2:57:38]: I apologize. I'll find it here in just a second, but um [2:57:39, 2:57:42]: When was that analysis done? [2:57:42, 2:57:47]: This this was done by the staff, uh and it was in their uh staff report. [2:57:47, 2:57:48]: When was that done? [2:57:48, 2:57:51]: This was prior to the planning commission meeting, so [2:57:52, 2:57:53]: [10674.8, 10676.3]: You cycle here it I found it. [2:57:57, 2:58:04]: That that information came from G D Doc's website, the average number of vehicles uh that travel that road per day. [2:58:05, 2:58:25]: Yeah, seventeen thousand two hundred uh vehicles per day. Um and our deficient uh additional traffic uh would was only a couple hundred vehicles a day. So it was kind of a drop in the bucket compared to the average digital traffic on. Thank you, sir. I do have follow-up question for you, Mr. Anderson. So [2:58:25, 2:58:26]: Because it seems like we're [2:58:26, 2:58:32]: Inconsistent and I don't know why. I need to understand. I know that there are some developers who do [2:58:33, 2:58:35]: Conduct a traffic study. Why wouldn't [2:58:36, 2:58:51]: that happen across the board? Um it didn't reach the thresh threshold. Um but it's not too late for us to ask for one. But uh it didn't reach the threshold that triggers um uh didn't reach the thresh the threshold. He only has a hundred units. [2:58:52, 2:58:53]: Okay, so [2:58:54, 2:58:55]: Stay right. [2:58:55, 2:58:57]: Mm. That road is being expanded. [2:58:58, 2:58:59]: Yes, it's not a good thing. [2:59:00, 2:59:02]: Because of the traffic volume. [2:59:02, 2:59:04]: Mm-hmm. You're adding to the volume. [2:59:05, 2:59:11]: Yep, yes. So I'm a bit confused as to why this would not be required. [2:59:11, 2:59:26]: for a development that's coming there to an area that's already heavily traveled. Yeah I I like the renderings. I do. I'm impressed with it. Um I'm just seeing it for the first time though, which I could have gotten it before now. [2:59:27, 2:59:44]: Um, but I have some concerns regarding the safety of this. If that study or analysis that you did was just done a couple of months ago and you didn't look at what the um traffic volume is during the school year. [2:59:44, 2:59:49]: Now the school is back in. I'm sure traffic has increased in the area. [2:59:51, 2:59:51]: Um [2:59:53, 3:00:07]: To be honest, South Code doesn't require a traffic study for a project of this magnitude. Um, but that was the most recent G DOT information that we provided in the staff report. Oh. Of the number of units traveled on that road. [3:00:08, 3:00:11]: Okay. Thank you, sir. [3:00:11, 3:00:31]: Follow up one more thing, if if you don't mind. So this product this uh this site is actually pretty unique as it has an existing D cell lane and left turn lane already installed. So there's not really any more um traffic measures that you can do other than that. I mean I think [3:00:31, 3:00:35]: think we all kind of realize they're probably not gonna put a light right there. It it so close to [3:00:36, 3:00:43]: Eagles landing, right? So we've kind of got all of the things already in. Let's say there wasn't a left turn landing. [3:00:43, 3:01:03]: Potentially G Dot would have come back and said, Okay, based on the traffic counts, you need to add a left turn lane. But luckily with this with this site, we already got one in. So that that really does help keeping people stopping in the middle of the road trying to turn in and all of that. So well it helps with the cost of the development, but it certainly does not help um alleviate or [3:01:03, 3:01:05]: Minimize um [3:01:06, 3:01:10]: Oh sure. Sure does. In the safety concerns. Oh absolutely. So I know [3:01:10, 3:01:11]: There's a median. [3:01:11, 3:01:13]: In the middle of the road there. Mm-hmm. [3:01:14, 3:01:16]: So if someone wants to turn in [3:01:16, 3:01:19]: Um turn left into the development. [3:01:20, 3:01:22]: I'm just concerned. [3:01:22, 3:01:23]: Yeah, now there's a left turn line. [3:01:24, 3:01:27]: There's a left turn lane, but there is no light there. [3:01:27, 3:01:29]: No no no, there's not a light there, no ma'am. Okay. [3:01:30, 3:01:30]: Is [3:01:31, 3:01:50]: I live in the area and I kinda know that it's heavily traveled. Yes ma'am. There are peak hours of the day and now that school is back in, um, traffic has picked up. Yes, ma'am. So I just I don't know if you all can add caution lights or fla I don't know, but it's certainly a safety concern. [3:01:50, 3:02:10]: Um for me there. That's all I have. Thank you. Thank you. Mr. Alexander, go ahead, please. I think and then in the end understand the long term process and understanding that we understand up here we raise traffic concerns, but under the law we address them the best way. [3:02:10, 3:02:30]: that we can and as the staff has described. And fortunately for us down the road, GDOT is going to widen this road. The right-of-way acquisition will start in 2027 and then hopefully the project will start a couple years after that. So there is some improvements that we know are coming to the area. [3:02:30, 3:02:50]: But growth is going to come and we know property rights have people have the right to sell their property. So we would ask you to do what's necessary in order to, as again, as I said, to try to s go back to GDOT and see whether or not that acceleration lane could be connected to the turn lane. The staff of the GDOT will tell you whether you can do it or not. [3:02:50, 3:03:10]: And what that would do is give the residents a out when they're coming out to turn out through there. And then again, there's a break in the median right at the gate. So basically you could go uh uh to turn the left because there's a break in the median, it's not a solid median at that point. These challenges always face us because it's always [3:03:10, 3:03:30]: Always gonna be some traffic situations coming there. But if we know as far as we stand, if you're gonna put the traffic somewhere, you want to put it against four or five lane Eagles Landing Parkway and in a destination that you know is going to be uh improved uh at this point. So [3:03:30, 3:03:37]: I appreciate uh the presentation and and and again the desire is to have the community be gated. Yeah. Yes. [3:03:38, 3:03:40]: Uh counselor, anybody and counselor any questions at all? [3:03:41, 3:03:41]: Okay. [3:03:43, 3:03:48]: This is it. So I wanna know, um, are you able to reduce the amount of units here to fifty? [3:03:48, 3:03:51]: As opposed to the hundred. Um [3:03:51, 3:03:52]: Well [3:03:53, 3:04:13]: The short answer is no. Uh again, you know, we could have uh I c you can look at the plan and kind of envision we could have gotten a lot more units on this plan than we did. Uh we felt like a hundred was a really good number. It was a good balance in between a low density and a high density. [3:04:13, 3:04:33]: Uh that's kind of why we didn't request a high density. Uh we just felt like the low excuse me, the medium density was a good transition between the lower densities to the east of us and the high density to the west of us. Uh because the park side is considered um high density and then the um [3:04:33, 3:04:37]: I think it's Lakeside to the east of us, that was more of a uh low density. So we felt [3:04:38, 3:04:57]: If we stayed in that that kind of that sweet spot of right around a hundred units, it's it it it was a good transition. So honestly, we really feel like it that's a pretty good number. It still makes the project viable. Um, you know, as you know, if you get to so few a units, it's it's not it's not even viable. So [3:04:59, 3:05:06]: You know, I I feel like you know, truthfully we could have gotten quite a bit more units on this project, but we just we just felt like this was a good sweet spot. So [3:05:07, 3:05:08]: Um [3:05:09, 3:05:13]: Where did I get a hundred and forty units from? When I'm was I reading the other [3:05:14, 3:05:17]: I think if we went to a if we went to if we had requested [3:05:18, 3:05:33]: uh a a change to a high density, we could have gotten a right around a hundred and forty, I think it was actually a hundred and sixty. Is that what you submitted your application for? No ma'am. No, it's been a hundred from day one. Okay. Uh I I um sorry. So the other thing I wanted to ask though. [3:05:34, 3:05:35]: Was [3:05:37, 3:05:46]: Just extending or adding additional uh homes, single family detached homes to Lakeside, was that not an option for you? [3:05:48, 3:05:50]: Uh well there's [3:05:51, 3:06:11]: There's homes all the way on the cul-de-sac on both sides. Uh excuse me, lakeside is to the east, correct? Yeah, that's right. Um there's not really any access through there. Uh there's a power line that goes through there that's pretty wide, uh, that actually separates our property from the lakeside as well. Um, but there was really no way to add a street through. [3:06:11, 3:06:15]: [11175.5, 11177.4]: Yeah, there just there really wasn't um [3:06:18, 3:06:20]: There really wasn't a way to do that. [3:06:20, 3:06:22]: And also you know, I go back to [3:06:23, 3:06:43]: We were kind of we were kind of targeting this type of product, like the two and the three story type of townhomes. There's not a lot of that right around through there. It's a really good location. It's close to all the amenities. And so we really felt like, you know, that's that's kind of uh a product that's missing in that area. So that's kind of the reason why we we went we went that route. [3:06:43, 3:06:43]: Right. [3:06:44, 3:07:01]: Thank you. Yes, ma'am. Last question. Okay, go ahead. Well, these will be three fifty to over four hundred. Thank you. And Kate, what's the square footage um for [3:07:01, 3:07:06]: Uh eighteen hundred to twenty three hundred. Thank you. Yes, ma'am. [3:07:07, 3:07:27]: If there are no other questions for the council, then I'll open up for the public uh hearing. Thank you, gentlemen. You have a seat for right now. All right, so I'm gonna open up to see whether or not then if we have anybody that uh any comments uh that people want to make for and against. So for any comments for this development, I'll start on my very left side over here. Anybody want to make any comments in my left side? [3:07:27, 3:07:43]: side. Anybody might make comments for this development in the middle? Anybody on the right side? Any comments for for this development? Okay, none. Anybody have negative comments, comments not for, not in positive no positive comments, don't want this development. Anybody on my left side? [3:07:43, 3:07:58]: Okay. If you if you wanna make a comment, man, stand up stand up and come right line up up here and I'll get you allow you to talk in just a little bit. Anybody else that has any negative comments or no stand by right there. Right there, man. So right there. You're right there. Uh anybody in the middle that have wanna make any comments uh against this project. [3:07:58, 3:08:00]: Yeah, you you wanna make a comment against the project, ma'am? [3:08:01, 3:08:04]: Uh right up behind this lady over here, please. Okay. [3:08:05, 3:08:18]: Any any anybody from my far uh right? And want any negative comments, comments uh discounting discounting this particular project? Okay, I see three individuals. Okay, ma'am, if you come to the mic please, your name and address. [3:08:21, 3:08:27]: My name is Janet Murick Beekler. My address is three one three Royal Crescent Way Stockbridge. [3:08:27, 3:08:28]: Okay, go ahead, please. [3:08:28, 3:08:35]: I'm sorry? Go ahead with your comments. Okay. I am not I'm kinda half and half. I'm not against the development. [3:08:35, 3:08:42]: What I am against is the number of units in the development. He's saying seven per acre. [3:08:43, 3:08:45]: Could it be reduced to six, five? [3:08:45, 3:08:51]: I don't want to see a variance. I'd like to see it stay at fifty and fifteen. [3:08:51, 3:08:53]: The other thing. [3:08:53, 3:08:54]: And I'd like [3:08:54, 3:09:06]: I'd like to understand this and I understand that traffic is not an issue for anybody for denying this. And I'm not asking you excuse me to deny this project. I think it's a good one. [3:09:07, 3:09:11]: I j what I don't like is the number because you're gonna put two hundred [3:09:11, 3:09:14]: Віякс он на род. [3:09:14, 3:09:27]: It takes me getting out of parkside on school days almost five minutes to make a left-hand turn. And the only road that I can make a left-hand turn to get out of my development. [3:09:27, 3:09:29]: is twenty twenty three. [3:09:29, 3:09:33]: We cannot make a left hand turn on Eagles Landing. [3:09:33, 3:09:34]: Because of the median. [3:09:35, 3:09:39]: So what you have to do is you have to cross three lanes of traffic and make a U turn. [3:09:40, 3:09:43]: Наб'ю дай. [3:09:44, 3:09:45]: So the other thing [3:09:46, 3:09:52]: Our driveway and this development's curb cut are directly across from one another. [3:09:53, 3:09:59]: Юсю хапина U-turn, mainly the trucks for the fencing компані. [3:09:59, 3:10:00]: In that same area. [3:10:01, 3:10:04]: And then you've got the left hand turns coming down. [3:10:04, 3:10:06]: I'm trying to get out. [3:10:06, 3:10:11]: They're trying to get out. We're directly across from one another. Not a good way to do a driveway. [3:10:12, 3:10:14]: Тей штер щоб alternating driveways. [3:10:14, 3:10:18]: No driveway should be directly across from another driveway. [3:10:18, 3:10:20]: You don't do that in a development. [3:10:21, 3:10:23]: There's z there's zigzagd. [3:10:24, 3:10:25]: Um [3:10:28, 3:10:30]: Let's see, what else did I have? [3:10:32, 3:10:37]: Again, I don't I don't wanna see the setbacks changed. I think they should be there. [3:10:38, 3:10:41]: Амінюкас дан он [3:10:42, 3:10:45]: Parks uh are on um twenty thirty [3:10:45, 3:10:47]: Twenty three forty two. [3:10:47, 3:10:54]: Where the houses are like California houses, right next to each other. You can stand between the lots and you can't spread your arms out. [3:10:55, 3:10:57]: If you have a fire, you're gonna have a problem. [3:10:59, 3:11:11]: Our homes are twenty feet apart on both sides. So there's there's forty feet of neighbor space. Fifteen. Whatever. Okay. But anyway. [3:11:12, 3:11:14]: I'd just like to see [3:11:14, 3:11:16]: The rules. [3:11:16, 3:11:19]: that are on your books adhered to. [3:11:19, 3:11:23]: If you say that the frontage should be fifty, it should be fifty. [3:11:24, 3:11:27]: If you say the fifteen on the side, it should be fifteen on the side. [3:11:28, 3:11:35]: What's the exception? What's the reason for the exception? Why do I need to do that? Because somebody doesn't want to mow the front yard? [3:11:38, 3:11:43]: I mean that's not a reason to make an exception. Okay. But I really think you should give thought to [3:11:44, 3:11:54]: How people coming out of both developments with people trucks, not just cars, trucks with fencing equipment on it, making a U-turn there. [3:11:55, 3:12:04]: Okay, thank you. Especially during busy traffic. Thank you for your comments. Thank you. Next next individual, please name and address. No, next individual. You're you're done, ma'am. [3:12:05, 3:12:06]: Come on, sir. [3:12:11, 3:12:14]: Name and address. Name and address, please. [3:12:14, 3:12:34]: Uh Victor Hudson, 178 Parkside Drive, Stockbridge, 3028Y. Thank you. Uh the traffic is my primary uh primary concern. Uh we've uh been in Parkside for the better part of you know what 20 years and the growth in the area, you know, which we appreciate growth has been slowly. [3:12:34, 3:12:54]: Substantial. Um coming out of parkside and making a left at the same entrance that we'll share with them would be problematic. No, uh when you're coming out, you uh make an immediate turn and uh you go down to uh Eagles Landing Parkway and then there [3:12:53, 3:12:57]: [11577.4, 11580.0]: so close to an intersection, which I get that. [3:13:00, 3:13:00]: But [3:13:01, 3:13:04]: In park's I no that was a bone of contention. [3:13:04, 3:13:14]: when that medium was placed there in the first place because uh you know, we were told originally that there would be a light, which of course it couldn't be that close to uh the intersection. [3:13:14, 3:13:22]: But uh I suspect the hundred townhomes uh initially were turning to one sixty at some point. [3:13:23, 3:13:30]: And uh that's even more traffic that you know we're gonna get. So I'd love to see a traffic study. If it came from [3:13:34, 3:13:41]: Or w we don't know the date of that study, but in the time I've been in Parkside I know there's been substantial growth. [3:13:42, 3:13:45]: So thank you, sir. Ma'am, if you can, name and address, please. [3:13:47, 3:13:47]: Okay. [3:13:51, 3:13:55]: Hello, my name is Tanya Jackson. I'm at eight thirty six rock lane. [3:13:55, 3:14:03]: Um and as the young lady um before me spoke, I'm concerned about the um the um reducing the requirements for the [3:14:04, 3:14:09]: the side yards and the and the setbacks, um and some of the um [3:14:09, 3:14:10]: Town home [3:14:11, 3:14:31]: um communities that I've observed, it seems like the closer the setbacks are, the more crowded the neighborhood looks. So I wouldn't be opposed to that. Um I do have a question um that came up since being here. I know the gentleman or someone mentioned that it would be front side brick or stucco and then someone else mentioned on the council that it would [3:14:31, 3:14:35]: be three size bricks so I was a little confused as to which would it which would it be. [3:14:37, 3:14:47]: We'll we'll get you that answer. Is that all you have, ma'am? Yeah. Okay, thank you. Uh she needs to talk to Scler. Uh Ryan and and uh uh builder, you need to come back up into the mic, please. [3:14:48, 3:15:08]: Mayor. Yes, sir. If you would, the condition was going to be that fifty percent of them would be uh full brick, three sides, and then there would be a water table on the back. And then the other fifty percent would be up to the residents to decide whether they wanted brick stone or stucco. Uh [3:15:08, 3:15:28]: Uh kind of similar to the p rendering that you had. It had some brick and then it had some um uh at the top there you got the uh concrete fiber board. So that's some flexibility. So the residents would get decide what the other fifty percent would be. Okay, that's when they bought the home. We're good with that, yes sir. Okay, that's one on okay and re could you just go ahead [3:15:28, 3:15:38]: Yeah, d we haven't voted on this obviously, but further explain explain about the setback requirement, what you're asking, why you're asking it for, things of this nature. If you s further explain that please. [3:15:38, 3:15:58]: Sure. So so the front setback again and and I think uh um this gentleman was telling he addressed kind of some ordinance changes that they're proposing as well to kind of match what we're asking for. Um that's pretty typical. I think he said the average is twenty five feet on a front setback on a town on development. That's right. Uh normally [3:15:58, 3:16:10]: I've done quite a few of these projects and I've never done one more than probably say thirty foot on a front setback. That's all over Atlanta. Um it's just that's kind of the that's kind of the um [3:16:12, 3:16:32]: The standard for what you want to do in a town on the valley. You try to pull the units a little closer to the road, reduce the front yard, reduce the maintenance, and all that kind of stuff. The side setback again is really to match what the ordinance says right now. Your ordinance says. [3:16:32, 3:16:52]: minimum of twenty feet between buildings. So that would mean 10 feet on one side of the property line and 10 feet on another. All right, but the ordinance says you got to have a 15 foot setback. So all we're trying to do is reduce it to meet the other part of the ordinance of the minimum distance between buildings. So that's all we're asking for there is is we're still [3:16:52, 3:17:12]: Obviously I'm familiar with the the medium in there. So otherwise I'd never thought about this I guess brought up there. So otherwise they're both uh driveways are facing each other, but they're on opposite ends of the road with the medium there and you gotta make the left turn. I don't know how else we can change other than do uh D Dok eventually or span uh D Dop eventually spanning the road some years from now. So I [3:17:12, 3:17:32]: I don't know if can you further explain that or uh and I and I was just having this conversation with with the very nice lady over here as well. So GDOT put that uh our driveway cut in there where they did for a reason. So we always try when we're designing driveways, GDOT has a rule that you always want to try to line them up with each other. [3:17:32, 3:17:52]: Reason is is because if you think about it, if you stagger the driveways, let's say you have somebody coming out of parkside and they're trying to take a left, somebody's coming out of ours and trying to take a right. Well, this person's accelerating, they're gonna run into each other. When they're lined up, you go like this. So you don't run into each other. So that's kind of the reason why [3:17:52, 3:18:11]: GDOT has a standard of always trying to line up driveways. In fact, they have minimum driveway spacings, offset driveways, so you can't be within like two or three hundred feet of having offset driveways. So there's they've got quite a bit of rules on that and and reasons why, but they put that driveway in where they did so it would be where it is. [3:18:11, 3:18:31]: Okay. Yeah. And when you explain earlier that hundred hundred units is what it's gonna be, could have been more, but but you felt it's best to have a hundred units there for this thing. Not lower but not higher, hundred is a great max uh uh great number for this development. Exactly. Okay. And when you get over a hundred, I think you have to have an additional driveway. Well, already people are you know, we're all complaining [3:18:31, 3:18:34]: about the traffic and stuff. So we tried to keep it at that sweet spot. Yes, sir. [3:18:35, 3:18:55]: Okay. That d this disregard that for now. Also otherwise and we talked about a traffic study. Traffic study wasn't done. It wasn't the the sit wit situation with the with the homes and the development's not needed, but then again you explained about the already the the actual uh cell reigns that that are already present there in this aspect. So that means the G D looked at that and says it's not necessary'cause this [3:18:55, 3:19:03]: already exist. And so it's it doesn't seem like it'd be any other way to expand any other d way here. You already have everything in place. That's right. [3:19:03, 3:19:15]: Okay. Ryan, anything else you can say about that, sir? Um no, sir. You you hit it on the head. All right. Yes, sir. If I could ask the owner, the applicant to come up. Mr. Moore and Mr. Patterson, y'all come up? [3:19:22, 3:19:42]: Now I'm gonna say this to you, Mr. Moore, and I and I know you all have you originally you said you thought about a hundred and forty, you got it down to a hundred. Yes, sir, yes sir. Which is a nice round number. And certainly we're trying to minimize what the traffic uh study or uh would impact would be. Is that the bottom number? Is there a [3:19:42, 3:19:47]: few more that you might be able to carve off. [3:19:47, 3:20:02]: We think we're at ninety-eight. Maybe ninety-seven. We're not gonna be any more than a hundred. It's we're somewhere between ninety-six and ninety eight units because there's a I don't know how to work this thing. Uh my kids aren't here. Um [3:20:03, 3:20:23]: There's up here it's kinda hard to see. Uh I don't know if I can point, but where the where the emergency exit is. Where the emergency exit is right here in the uh emergency ingress egress. Yes, sir. There is a power line. There's a power line easement that runs down actually [3:20:23, 3:20:35]: both sides of the property. One is the uh Lakeside community and there's one right there. And I think we're gonna lose I think we're gonna lose one of one or two of these townhomes right here in the [3:20:35, 3:20:41]: Okay. Okay. Let let's say this then. Let's let let's say let's make that number ninety seven. [3:20:41, 3:21:00]: Okay, that's fine. Yes, sir. Okay. So that'll be three that we'll lose off of there, but certainly you know, somebody would probably wouldn't want to live under power. So we'll go from uh a hundred down to ninety seven. That's pretty much that still makes the project viable for you. Okay. Yes, sir, sure does are you agreeable to that? Yes, sir, we sure are. Okay, thank you. [3:21:00, 3:21:03]: Okay, any other c any other questions from the council? [3:21:04, 3:21:05]: Yes. [3:21:05, 3:21:08]: I still have um there's the safety concern. [3:21:09, 3:21:17]: And I know you under you just explained about why G Dot aligned the driveways um or the entranceways to [3:21:17, 3:21:37]: Park side and this proposed development, but there's still an aspect of safety concerns. Uh I think your subdivision has the same thing. If you'll go to I don't know how to go here, but on East Lake Road, you you're you're right across the street from the continuance of your subdivision. Right. So that's all they're trying to do. These are rules and laws that we can't [3:21:37, 3:21:44]: Can't change the city can't change. Mr. Patters can speak to it because he was over the engineering for all of Henry County and DOT. [3:21:44, 3:21:50]: They required it that way and and and that's that's where they are. You are gonna widen it, but [3:21:50, 3:21:58]: But I mean, it's always a concern. I have children, I've had children being wrecks, and yes, it's it's a it's a definite concern, but at the same time [3:21:59, 3:22:01]: My kids went to school right here by Eagles Landing Christian. [3:22:02, 3:22:20]: For fifteen years from kindergarten all the way through graduation, some construction was going on between seventy-five and their school. So I mean I I understand and I uh you know but when I'm pulling out of even my subdivision, you just mentioned the other side of Lakeside onto East Lake Parkway. [3:22:20, 3:22:26]: Us going head on. I'm trying to turn left. They're trying to turn left. Yeah, it's yeah. [3:22:27, 3:22:36]: That is a concern of mine. Well they have two lanes there, so you should be able to easy you know, turn left each of you. You know that? But [3:22:36, 3:22:47]: Um so I really wish that you could expand onto um lakeside with single family detached homes, but I'm [3:22:47, 3:22:52]: It's a forty foot there's a forty foot drop off and there's houses behind there. [3:22:54, 3:22:55]: No all right. [3:22:56, 3:23:08]: All right, so uh if there are no other questions, uh we're gonna t well thank you gentlemen, appreciate it. Okay, so uh comprehends a plan amendment K C P two zero two four dash zero six. Once again, council district five [3:23:09, 3:23:29]: Council consideration request a comprehensive plan amendment to change the future and land use designation of two parcels on each side of Highway 42, north south, north, south of Eagles Land Parkway from low density mix use to medium density residential to allow for construction of townhome development. The applicant ILI Route 23 L. [3:23:29, 3:23:33]: L L C and Agents George Harper Empowerment Empowerment Engineering. [3:23:34, 3:23:54]: The property contains two parcels as listed below, 13.64 acres within the city limits stop bridge. And the parcel number 069-01009000 contains 10.61 acres in landlost one and two of district seven and eleven. And parcel uh number zero seven [3:23:54, 3:24:05]: 2612 Highway 42 contains 3.3 acres of land lot uh one of District 7. Need a motion to accept this this change. [3:24:06, 3:24:25]: May I make to make a motion to approve and also point out that this has been the thirty foot setback has been um well we'll the standard of what we've been doing in the other developments in district four. Well we'll get to that. We'll get to that. We gotta take w each one of these one at a time so we have a vote on each one. So we'll get to what you're talking about. So move. Thank you. Is there a second? [3:24:26, 3:24:29]: Miss Barber Ms uh uh Gantt second, all favor please indicate. [3:24:31, 3:24:51]: I will abstain. Okay, so 401. Uh Ms. Barber abstains. Okay. For rezoning case RZ 2024-06, Council District 5, consideration of a request for rezoning to rezoning to rezone two parcels on the east side of Highway 42 North, south of Eagles Land Parkway from C to General Park. [3:24:51, 3:25:11]: Commercial to F MFR multifamily residential to allow for the construction of townhome development. The applicant LI Route 23 LLC and the agents George Harper of Paramount Engineering. The property contains two parcels as are listed below, 13.64 total acres within the Starbury City limits. Variants to require [3:25:11, 3:25:31]: Request RV 2024-06 with reduced in front yard setbacks, the townhome lots from 50 feet to 30 feet. Parcel number 069-0100-9000 contains 10.61 acres, landlots 1 and 2 of districts 7 and 11. Parcel number 07900. [3:25:31, 3:25:43]: This is what [3:25:44, 3:25:51]: Excuse me. I got one question. Yeah, what's your one question? Yeah, what's stand by Mr Thomas? Yes, what's your question? Why is it multifriendly? [3:25:52, 3:26:04]: Well, is townhomes. Yeah, they're part uh in the MFR district. Townhomes are part of the MFR district. Part of the multif uh multifamily residential t uh district. [3:26:08, 3:26:11]: No, mm mm.'Cause it's it's single family detached. [3:26:12, 3:26:14]: It's S R and R R. [3:26:18, 3:26:21]: No, I mean uh no, it still would be a MFR. [3:26:22, 3:26:28]: So you have single family detached. It's still single family, but it's part of multifamily because the buildings are connected. [3:26:29, 3:26:41]: But they still can be, I mean, a single family residence. Okay. Yeah. Remember forward. Yeah, yeah, Mr Thomas go ahead. I want to tell you. Oh, guess something else sir, I'm sorry. I think you uh missed uh R Z twenty the the rezoning. [3:26:42, 3:27:02]: I thought I just read Rizona. Oh, I just read the result. Rizona was next. Rizona is what I just read. Okay. All right. So ms Ms. Thomas, you good? Okay. Okay. Now this is where the conditions will come in and we talked about the gated community with flock cameras at the [3:27:02, 3:27:22]: The entrance. The 10 foot most used path along highway 42 23, the entire frontage, six foot sidewalks inside the development. You say six foot? Yes, instead of five foot. Six. Acceleration lane for the development. Minimum square footage, 1800 to 20. [3:27:22, 3:27:42]: Square feet, square footage. We are incorporating the two levels, and then the three levels will be 65% two levels, 35% three levels. 50% of the units, brick and [3:27:42, 3:28:02]: cement fiber 50% of the units will be all brick. The sides of the unit will be brick with a water table on the rear uh of the unit and then the other 50% will be flexible flexible for the applicant. Flexible for the applicant. Right. Okay. Come to the mic please [3:28:02, 3:28:22]: Come to my place and you're saying a mix on the we didn't have a percentage on the two-story or three-story. We're gonna let the market dictate if the market dictate. Okay, sorry, sorry if the market dictate if they build 85 three-story. Right, right. That that's what we discussed. He's correct. He's correct. The minimum square footage will be 18, and then you will let the market determine what how many we will build of each. [3:28:22, 3:28:42]: Okay. That's correct. I'm sorry. I I that was that was an old note that I'm reading off of, sorry. And then there would be a clubhouse, a pool, a pavilion, and an outdoor grilling area with a fire pit. Right, right. The clubhouse pavilion is one one building without yes, sir. Right. Yes, sir. You had those conditions written down. [3:28:42, 3:28:47]: Yes, yes, ma'am. I think okay, I didn't hear you say ten foot footpath, Councilman Alexander. [3:28:48, 3:28:53]: I thought I did. Ten foot path along the entire frontage of Highway forty two twenty three. [3:29:02, 3:29:13]: Okay. So that's my motion. Okay, that's your motion. You're good with everything that you just mentioned, sir. Yes, sir. Yes, sir. All right. That's his motion. Is there a second to a motion? I second. Ms. Gantt second that. All in favor, please indicate. [3:29:15, 3:29:25]: Ms. Barber, you you voted how you voted? This is for which of the items I've lost track of where we are. The rezoning. We're talking the rezoning. Number twelve, rezoning. We should vote. [3:29:28, 3:29:44]: Okay, so this is um the rezoning. Yes. For the MFR. Is this where the fifty feet now the variances coming up next? That's coming up next. Say it again. The variance is coming up next. We're on the rezoning now. [3:29:44, 3:29:50]: Okay, but I'm looking at item number twelve and it mentions reducing the front yard setbacks. [3:29:50, 3:29:52]: Under the rezoning case. [3:29:53, 3:29:57]: It does say it resoned uh uh townhome lots from required fifty feet, thirty feet. [3:29:59, 3:30:00]: Mm-hmm. [3:30:00, 3:30:01]: Okay, so [3:30:04, 3:30:09]: We're on number twelve. We're on number twelve. I just read twelve. Yes. [3:30:10, 3:30:10]: Roll number twelve. [3:30:11, 3:30:13]: Sorry. We're on number twelve. [3:30:13, 3:30:14]: Correct. [3:30:15, 3:30:18]: So he just mentioned all of the conditions. [3:30:18, 3:30:19]: Under the rezoning [3:30:20, 3:30:27]: Yes, that's where they go on the So does that also include the thirty feet setback that he's requesting? [3:30:28, 3:30:30]: No ma no ma'am, he didn't include that as a condition. [3:30:31, 3:30:33]: That goes on the s that goes on the variance, right? [3:30:34, 3:30:34]: Yes. [3:30:35, 3:30:48]: But that is not okay, so I'm confused. I'm looking at the agenda. It's in and it's counting case. We can add it. But can I finish my comment before everybody start cutting me off? [3:30:50, 3:30:52]: Looking at item number twelve. [3:30:53, 3:30:56]: You see it, Mr. Andrew? Yes yes ma'am. Okay. [3:30:56, 3:30:57]: But [3:30:57, 3:31:02]: You're saying this variance request it should be under thirteen. [3:31:03, 3:31:05]: Yes, ma'am, that's the variance request. [3:31:05, 3:31:10]: Okay, thank you, I see. The last line up here should have been [3:31:10, 3:31:14]: is duplicated on item thirteen. Thank you, sir. Um [3:31:14, 3:31:18]: You so then I wanted to ask Councilman Alexander, are you gonna consider [3:31:19, 3:31:21]: Um as a condition [3:31:21, 3:31:33]: Requesting that um a percentage of the units be reserved for public service workers, as we mentioned during the retreat, like police officers, school teachers, nurses. [3:31:36, 3:31:40]: I certainly support that, but did we formalize that in any way? [3:31:41, 3:31:42]: I I don't think we did. [3:31:43, 3:31:44]: I don't think so. [3:31:45, 3:31:48]: So uh Mr. Moore, what what what are your thoughts on that? [3:31:50, 3:32:00]: I think that would be a great idea, but I think federal housing will not allow you to stipulate what somebody's occupation has to be. [3:32:01, 3:32:21]: I mean I'm not a expert in the law of that, but I do know I'm a real estate I mean real estate that you can't you can't discriminate against, you know, what somebody's occupation is in buying an F H A or B. Is Quentin over there? It's wolf. So I don't think I I do know this. I do know that a lot of the builders will give will give uh [3:32:20, 3:32:40]: the uh the um first responders and everything they give them extra you know they'll throw a washer dryer in there different things that they will do so you're agreeable to incentives incen any any type of incentive for first responders and uh and school teachers, yes sir. I mean we were trying to attract young professionals here. So okay so we'll include uh that [3:32:40, 3:32:53]: in there that there would be some incentives. As long as it doesn't break any house housing rules regulators. Is that good? Okay. All right. So how how do we need to have that verbiage to make sure we understand? [3:32:56, 3:32:59]: Yeah it is a c I was made man, it will say it is a condition. [3:33:00, 3:33:01]: They're adding. [3:33:05, 3:33:09]: We don't look like any problems taking a vehicle. [3:33:10, 3:33:16]: It'll be a suggestion as the city manager recommends us you I I know you would do it anyway'cause it's certainly gonna benefit you. [3:33:17, 3:33:18]: Yeah. [3:33:19, 3:33:20]: Okay. So we ha [3:33:21, 3:33:26]: So suggest okay, so be a suggestion. So otherwise you have you have that, Madam Clerk. Okay, wait. I have [3:33:27, 3:33:28]: I'm I'm sorry, Madam Clerk? [3:33:30, 3:33:30]: Okay. [3:33:30, 3:33:31]: Okay. [3:33:32, 3:33:34]: All right. Got it. Thank you. Good deal. [3:33:34, 3:33:38]: So with all that that was said, y uh yes, Miss Barber. [3:33:43, 3:33:45]: When we discussed um [3:33:46, 3:33:46]: Oh [3:33:47, 3:33:51]: new proposals and developments that come forward. [3:33:52, 3:33:57]: And I don't know whether y'all all got amnesia uh amnesia because I said it. [3:33:58, 3:34:04]: What I've been asking for for the past couple of years is that we include this. [3:34:04, 3:34:06]: in our code. [3:34:07, 3:34:11]: Just as we require there be a ten percent rental cap. [3:34:12, 3:34:15]: I'm also asking that we include in [3:34:15, 3:34:19]: A percentage. I don't know, two percent, three percent. [3:34:19, 3:34:23]: of all new developments be reserved [3:34:23, 3:34:26]: For public service workers. [3:34:26, 3:34:27]: Now [3:34:28, 3:34:35]: I don't know if Mr. Gardner or Mr. Washington, the city attorney, needs to do the research. [3:34:35, 3:34:37]: On the legality of it. [3:34:37, 3:34:44]: But the reason why I suggested it is to offer them some type of discount on the sale. [3:34:45, 3:34:46]: Of a unit. [3:34:46, 3:34:49]: is for public service workers. Right. [3:34:50, 3:34:52]: Not just incentive a wash and dryer. [3:34:53, 3:34:54]: No. So [3:34:56, 3:34:57]: It warning. [3:34:58, 3:35:18]: Is if you make that a condition, it's hard to enforce who's gonna enforce whether or not they have a public safety official there. That's gonna be one of the issues. I mean, we just can't police that. No one's gonna be out there every time someone closes on a house. Um second, uh uh the law by saying specific people, no [3:35:18, 3:35:22]: Uh, I know what you can do is you can say, Hey, can we have an affordable [3:35:22, 3:35:24]: Of affordability cap. [3:35:24, 3:35:36]: Where you could say, Hey, can X mod of these homes be set aside for low to moderate income families, which would include those folks? Because I I want you all to understand, your typical police officer [3:35:37, 3:35:42]: Makes fifty thousand dollars a year. If these homes are in the four hundred thousand dollar range, they can't afford it. [3:35:43, 3:35:47]: Right, um, so what you do is you try to ask for an affordability cap. [3:35:48, 3:36:08]: Um, to say, hey, can 5% or 2% of the homes be set aside for load-moted income? And part of that is they will have their lenders work with those entities that come in and they can be public safety officials. And this is something when we talked about that, I mentioned the chief, that Henry County actually have down payment and ho and closure. [3:36:07, 3:36:24]: closing cost assistance for specifically um that goes to public safety officials, police, fire, first responders. Right. And I and I think that number has gone up now to like twenty, twenty something thousand now per per household. [3:36:25, 3:36:26]: Um [3:36:26, 3:36:46]: And that's just something that these guys gotta, you know, go through the process with. But if they're willing to do something like that, uh, you can. But to just directly say it has to be a public safety person, uh that might be a problem. But if you say, hey, can you set aside two percent or five percent of the units as affordable units to load and mortal income families? And then [3:36:46, 3:36:50]: Their their their mortgage pricing could work around, you know [3:36:50, 3:36:54]: You know, being able to work with those people to give them the issues to bring the price down. [3:36:56, 3:37:05]: So then how are we able to I know you just mentioned that there's no way for us to track um that two percent that we [3:37:05, 3:37:11]: may ask to reserve for public service workers. Well then we can't track [3:37:12, 3:37:25]: the rentals either. No not rental. For sale. So and a part of the code allows for ten percent rentals. So why can't we also allow [3:37:26, 3:37:35]: Two percent to be rented to public service. So so the rental issue is pretty much not controlled by us, that's gonna be controlled by the HOA. [3:37:35, 3:37:38]: 'Cause that's outside of our purview. That's controlled by who? [3:37:38, 3:37:53]: HOA. Like most HOAs allow don't allow you to have X amount of homes in a subdivision for rental. And then they control that by watching to see who's doing what as it relates to paying your assessments. We can't monitor that. Cities don't monitor that. That's outside our purview. [3:37:54, 3:37:58]: Um legally we can't I mean cause if we can say you do ten percent. [3:37:58, 3:37:59]: How we gonna know? [3:38:00, 3:38:03]: Right. I mean we could go to the tax register and check. Yeah. [3:38:03, 3:38:08]: I mean, but imagine his staff trying to do that for how many subdivisions in the city? [3:38:09, 3:38:14]: Um to track that. I mean that's a separate person trying to do that job in and of itself. [3:38:14, 3:38:15]: Um [3:38:16, 3:38:35]: But, you know, once again, I mean, even when it comes to affordability, you know, somebody's you know, yeah, somebody's gotta be able to say, Okay, what's an affordable item? If it's four hundred, uh, are we setting aside a unit, two or three or four units at three hundred that makes that affordable? And you know. [3:38:37, 3:38:49]: I I don't know. It it just becomes so cumbersome to try to track all of this stuff because it just put a extra burden on on on your staff um to try and track this for every development that comes through. [3:38:50, 3:38:57]: Um you just hope in good fate that they do they provide those and say, Hey, we're providing X amount at [3:38:57, 3:39:08]: at um affordable uh uh for load or mortar incomes and their person who's selling those homes, identify those applicants. And if they get'em then they can share that data with us. But to like [3:39:08, 3:39:10]: Go in and try to track that is hard. [3:39:14, 3:39:21]: All right. So we m have we had a motion and it was seconded. So we I'll take the vote again. All in favor of the motion as indicated, please indicate. [3:39:22, 3:39:23]: Okay. [3:39:23, 3:39:28]: All right. So Miss Barber, you're approving. Okay, so it's five five oh. All right. [3:39:29, 3:39:31]: All right. [3:39:33, 3:39:53]: Variance case RV two zero two four-02 variance request number one to Council District Five. Consideration of variance requests for two variances on two parcels on the east side of Highway 42, north south of Eagles Lion Parkway to allow for construction of a town home development. Variance request number one would reduce the front yard setback. [3:39:53, 3:40:13]: Of the town hall lots require 50 feet to 30 feet. The applicant is LI Route 23 LC. And agent is George Harper of Paramount Engineering. The property contains two parcels as listed below, 13.64 total acres within the stop and city limits. Parcel number 069. [3:40:13, 3:40:33]: Contains 10.61 acres in landlots one and two of District 7 and 11. Process number 070-0100-1000. 2612 Highway 42 North contains 3.03 acres in landlock 1 of District 0.
