--- title: Work Session Meeting date: 2022-06-29 source: 2022-06-29_Work_Session_Meeting.wav --- [0:00:00, 0:00:20]: Mr. Gardner with subsection T uh T, subsection T, which in our previous ordinance uh made it impermissible for people to essentially sag their pants. And we think that we're we're we're not in a uh a time that uh we need to be enforcing sacking pants ordinances, and so we would ask that then be removed. [0:00:20, 0:00:38]: removed from the municipal ordinances and not be considered uh in offence by the house. Remotion to approve excluding uh action item number T uh from this motion. Okay, is there I said Gantt okay Ms. uh K Alexander to uh Gantt and thank you Chief all in favor please indicate [0:00:38, 0:00:40]: Okay, you now have a decision. Thank you very much. [0:00:41, 0:00:52]: All right. Council consideration to amend Starbury's Code of Ordinances, Chapter eleven point zero four point one zero zero, general offenses weapons discharge prohibited. Chief Tramor, please. [0:00:53, 0:01:00]: Yes, sir. Thank you. This um is an amendment to be working for the current evidence that exists and it expands upon the [0:01:05, 0:01:06]: Okay, uh I would speed it. [0:01:08, 0:01:28]: I'm sure you all have seen and there was an episode in in Ohio uh back in June where there were a group of young men that were shooting splatter law guns, essentially uh sort of a pink law gun and others, and uh that ultimately resulted in in somebody's death as a result of that. So we wanted to to again expand upon that to make it admissible. [0:01:28, 0:01:40]: for uh folks who and if you look at there's there's obviously requirements if they're in a place of business that you know is involved in you know pinkball operations or something along those lines that's a little bit different. [0:01:40, 0:01:45]: And uh obviously Turkey shoes, license firing ranges, the things are all uh excluded by [0:01:49, 0:01:59]: Okay, I need a motion, ladies and gentlemen. So moved. Of Mr. Blount. So moved. Ms. Ms. Gardner, second that. All in favor, please indicate. Thank you. Announced decision. Thank you very much. [0:02:00, 0:02:17]: Council consideration to amend Stockbridge Code of Ordinances, Chapter eleven point zero four, general offenses, section eleven point zero four point one four zero general offenses uh defecating or urinating in public property or in certain areas. Chief Tramor, please. [0:02:17, 0:02:25]: Um it's I guess for itself pretty obvious. Um we linked it to [0:02:31, 0:02:37]: Okay. Any motion to accept this please? Motion to accept. Ms. Barmer. Okay. A second? Is there a second? [0:02:37, 0:02:37]: Okay. [0:02:38, 0:02:41]: I need a second. Second. Okay, Mr. Blount, second down. All in favor, please indicate. [0:02:42, 0:02:43]: Snapsy says thank you. [0:02:44, 0:02:45]: All right. [0:02:46, 0:02:59]: Council consideration to add a new ordinance under Starbucks Code of Ordinances Chapter 11.04, Section 11.04.150, monetary solicitation. Chief Tramor, please. [0:02:59, 0:03:00]: Thank you. [0:03:01, 0:03:04]: Currently the city does not have an order to address monetary solicitation. [0:03:05, 0:03:12]: This is something that's come up as an issue, a matter of concern for the community. Um and we see it, I think, as we come into the city. Um [0:03:13, 0:03:33]: There's a lot of hand handling, a lot of things that are happening, and um I I know there are a number of things that it's something that I don't think that we can uh allow or tolerate. We obviously want to uh make sure that we direct people and services as appropriate, but uh you know we cannot uh I I believe we can't allow these things to occur and you have to be [0:03:33, 0:03:53]: Specific because uh there are certain First Amendment uh protections that relates to solicitation, and so we've been clear in terms of what areas it is and it's not permissible. Uh one of the things that uh I want you to be aware of is that there uh was a revision that we made earlier today uh that differs from what you have uh [0:03:53, 0:04:13]: for you and uh that was adding item number four which makes it impermissible to solicit money within fifteen feet of the entrance or exit from any highway or interstate and then we struck uh item number five which made it illegal to solicit the fifteen feet of pay phones because I I'm not sure that there are payphones that exist uh [0:04:13, 0:04:20]: um getting word presently. This is something that's pretty standard language in most municipal ordinances. [0:04:30, 0:04:50]: Standard monetary solicitation, there is another part that addresses with aggressive monetary solicitation and has specific requirements irrespective of where they're situated. So they don't have to be in a certain place. If they're blocking somebody's path, if they're not allowing people to leave, if they're using profane or abusive language while soliciting money from people, it makes it a violation. [0:04:50, 0:04:57]: By virtue of their actions, and so that's separately addressed and the aggressive monetary solicitations is still under the same. [0:04:59, 0:05:00]: Right. [0:05:01, 0:05:17]: Council go ahead, sir, please. How going over this, how would you address issues like we've had when they're uh on the corner before they get in the parking lot, which is obviously more than 15 feet financial way of any business there. [0:05:17, 0:05:26]: But that solicitation on the corner coming into the parking lots, which are more than fifteen feet. I'm which I'm trying to figure out which one of these would address that. [0:05:27, 0:05:47]: And so as I mentioned before, and you can look, there's actually some some some uh higher court rulings that that say that soliciting money is actually protected speech. That people if people are able to request money so long as they're not doing it within certain parameters. And so in general, if you were to ask somebody [0:05:47, 0:06:07]: For money walking down the sidewalk or in the entrance to a parking lot or something like that, and it's not clearly defined here, then that would not be a violation per se. However, if that person refused them and they continued to follow or they continued to ask money, um, or you know, you can handle it separately as a trespass violation if [0:06:07, 0:06:27]: If you have an agreement with the property owner, or they say that we don't want these people here that you can trespass them then from that property and they would come back within be a violation at that point in time. But the courts have decided you can't just throw a blanket statement out there and say you cannot solicit anywhere. There have to be clearly defined guidelines in terms of where you can and cannot solicit in the [0:06:27, 0:06:29]: manner in which you can or cannot solicit. [0:06:32, 0:06:32]: You good? [0:06:33, 0:06:37]: Yeah, I I guess I would have to talk to you uh you know [0:06:38, 0:06:46]: Away from this on that, Chief,'cause I'm just trying to figure out when when you have those you got a certain group of people around the county right now. [0:06:46, 0:06:52]: And in the in and I know in our area particular, in the Eagles Land area, there's they sit [0:06:53, 0:07:00]: on those corners with those signs. Some of them even act like they're playing violins, which the music is coming through the box. [0:07:00, 0:07:02]: They're they're soliciting [0:07:03, 0:07:11]: And I guess being a nuisance and having rights as a nuisance is is is uh I guess it gets a little sh sticky right there, huh? [0:07:12, 0:07:15]: Yeah, but some of those cases like when you and I was [0:07:20, 0:07:22]: lines of somebody need you know you know. [0:07:22, 0:07:30]: a fraudulent scheme trick, device, artifacts or something to to to gain money for somebody. That's something that could be potentially gained down there. [0:07:30, 0:07:50]: City does have a no solicitation ordinance already that makes it impermissible for people to solicit uh within the city without a permit. So uh that ordinance may be something that would be uh applicable and something I would have to look at. I think yeah, that's why I said I'm um since I didn't see something on here, I would just talk. [0:07:50, 0:08:03]: to you further about that in person. Thanks. Okay. Any other questions? And if not, need a motion to accept this uh change. So moved. Okay. Mr. Alexander, I'll give Miss Barber a second. Okay. Uh all in favor, please indicate. [0:08:04, 0:08:07]: Unanimous decision. Fantastic. [0:08:08, 0:08:22]: Council consideration to add new ordinance under stop breach code ordinances section eleven point zero four section eleven point zero four point one six zero false representation to police or any city department. Chief Tramor, please. [0:08:23, 0:08:24]: Is this essentially um [0:08:44, 0:08:45]: [527.1, 532.4]: Questions? If not, uh I need a motion to accept. So okay, Miss Barber, second, any second? [0:08:53, 0:08:56]: No, Mr. Blount, second that. Okay, all in favor, please indicate. [0:08:57, 0:08:59]: Okay, you now says thank you very much. [0:09:01, 0:09:18]: Okay, Council Considerations of Man Stockbridge Code of Ordinances, Chapter 11.04, Section 11.06, Section 11.06.010, Administration of State Offenses in Municipal Courts to add clarifying language and to remove duplicate phasing. [0:09:19, 0:09:21]: Um presented by Chief Tremor, please. [0:09:22, 0:09:42]: So thank you. This offense again is a modification of uh ordinance that's already in place. Essentially gives the court the authority to hear certain state offenses permissible for municipal courts to hear. This was brought about through discussions with Judge McCord, and uh we wanted to expand upon what [0:09:42, 0:09:50]: offensive specifics were going to be brought before municipal court. And um you know as you can see here, possession marijuana less than an hour [0:09:54, 0:09:57]: things there as opposed to state court uh [0:09:58, 0:10:05]: operating motor vehicle without insurance is computer fed by shoplifting, uh furnishing alcohol or beverages to persons under twenty one. [0:10:08, 0:10:10]: Okay, thank you. Questions council? [0:10:10, 0:10:26]: Yeah, one minor couple. Oh, go ahead, please. I had a question that was interesting and I didn't know the answer to, which was if the Henry County police will still be patrolling, if they encounter somebody inside the city limits and they were to write a side, would that come to our court because it's in the city limits? Is that correct? [0:10:35, 0:10:35]: Yeah. [0:10:36, 0:10:40]: Kelly, I would I I believe that's how they handle that. They have the authority to be able to [0:10:40, 0:10:45]: But they're not obligated to handle any cases unless there's some other agreement [0:10:48, 0:10:55]: So they can write they'll be able to write tickets in the city limits and then take it away from and and take it to their court, state court. [0:10:56, 0:11:16]: I understand that they didn't get they don't get any revenue from state court with the argument that we had, so we might need to have a discussion with them to make sure that they direct those. Because when the money goes to state court, for our understanding legally was that that none of that money would come back to them or us. That was a discussion that we had with them. So we probably need to have a discussion with them. [0:11:15, 0:11:22]: them to direct them to municipal court. I again looks like Ms. Gann you have something you need to say. [0:11:22, 0:11:30]: Yeah, I I kinda disagree, but I I I get what what you're saying. I think and I agree with you, Councilman Alexandra. [0:11:31, 0:11:47]: Um but because we now have a a st uh police department and we have an active court, um, and our police department can write state charges too, when Henry County is in our jurisdiction in the city limits of Stockbridge, [0:11:50, 0:11:55]: I thought that they had to write the ticket in the jurisdiction of which [0:11:55, 0:11:56]: They [0:11:56, 0:12:16]: w w where they are. I get it, if they go down to state court, um, it's a state violation, but we too handle state violations and it's in our jurisdiction. So I I if you don't mind just checking up on that chief and making sure that if they are in the city limits of Stockbridge, um [0:12:16, 0:12:22]: Um whether or not they have whether or not they are going to write tickets directly to you know [0:12:22, 0:12:31]: whether or not those tickets will go to the city of Stockbridge is is the question. Um and I I believe that they do, me personally. [0:12:32, 0:12:45]: But let's just On that on that note, Mr. Gardner, you have any comments about this at all? In reference to this? I'm pretty sure this is gonna involve you. Your involvement have you involved in this? You got any comments, sir? Okay. I'm sorry, go ahead, Chief. [0:12:46, 0:12:50]: I was gonna say I can I can check with the city of McDonald and some others and see [0:12:54, 0:12:55]: Yeah. [0:13:00, 0:13:12]: Okay. Thank you. Any other questions for the council? If not, need a motion to accept is uh changed. So move. Okay, Mr. Alexander, second. I second. Did you did you Ms. Gantt? Ms. Gantt, second that? Okay, all in favor, please indicate. [0:13:13, 0:13:15]: Okay, unanimous decision, thank you very much. [0:13:17, 0:13:30]: Okay, Council consideration to add a new ordinance under the Stockbridge Code of Ordinances, Chapter eleven point two zero, Section eleven point two zero point zero three zero notering for illegal sexual purposes, presented by Chief Tramor, please. [0:13:31, 0:13:34]: Uh yes, thank you. This is a new ordinance. Uh [0:13:44, 0:13:48]: another mid act of prostitution, sodomy, masturbation for hierarchy. [0:13:49, 0:14:00]: We currently do not have this in the ordinances that we believe and so this is probably taking place in some of the hotels around the area is something that would be the mechanism place where you'll interest this as appropriate. [0:14:01, 0:14:07]: Okay, questions council. If not, need a motion to accept this proposal. This new ordinance new ordinance. [0:14:07, 0:14:09]: So moved. Ms. Gantt, second. [0:14:10, 0:14:13]: Uh mister Mr. Blount, second that okay. [0:14:13, 0:14:14]: All in favor, please indicate. [0:14:15, 0:14:17]: Okay, you now have a decision. Thank you very much. [0:14:18, 0:14:30]: Council consideration to add new ordinance under Stockbridge Code of Ordinances Chapter eleven point two four, section eleven point two four point zero three zero Urban Camping, presented by uh Chief Tremor, please. [0:14:31, 0:14:40]: Yes, as we know again, uh there are an issue with a number of places in the community where there's been campus that's been set up. Currently we don't have uh the [0:14:55, 0:15:15]: For these violations, it actually says in the ordinance that nobody should be arrested without proceeding or warning a police officer. So we want to make sure that we're warning people. There's also a provision in there that if we have these encampments and there's abandoned property, it gives us the authority to be able to dispose of those things as abandoned property. [0:15:15, 0:15:20]: provisions there obviously if we had algorithms or something along those lines what people would set up [0:15:24, 0:15:44]: Okay. My initial thought makes me think of what homelessness is one and then I'm thinking if uh if you give a warning, um and I know that we uh we're along with the county and some other agencies are looking at what we have to deal with homelessness across the entire county itself, which would involve even medical folks and this nature. So I'm kinda wondering say the [0:15:44, 0:16:04]: we pass this at night, I'm kind of thinking it may have to change over the course of time as we develop something more wide widespread for the county itself, along with things we may have to do in the city, I guess. I'm just kind of thinking out loud in in a sense. I I don't know if we got any thoughts on that right now, Chief, or not. But yeah, I don't know that it would change because what we're what we're addressing this condition, we're not addressing the issue of homelessness, we're addressing. [0:16:04, 0:16:05]: [965.8, 985.1]: That's people setting up in little cities and things along those lines. We're actually working, our community affairs units working to put together a resource list for people that are homeless or those that are soliciting because we want to have something to be able to provide and say, hey listen, you can't do this, but here are some resources for you to explore. [0:16:25, 0:16:45]: And uh give them some options available. We'll warn them, we'll document that. And um again, we're not immediately going to arrest people, we want to give people an opportunity to comply, but we also provide them some resources in the event they're not familiar with that. And it's certainly something that I think needs to be addressed. I I've gotten, I'm sure you all saw an email just came in the other day. [0:16:45, 0:16:55]: about one of the business owners of the Dollar General that um we're over there at the Dollar General where somebody was in and hanging out and camping uh heading around their business and we had [0:17:05, 0:17:25]: the community and for our citizens uh and businesses and so we need a mechanism in place in order to be able to address and again we understand you know people's plights we understand situations and we're gonna be compassionate um in in addressing those issues but uh at the end of the day some people are not going to comply and we [0:17:25, 0:17:45]: Need to have a mechanism in place. And so you know, too, I've also discussed this with Judge McCord. And um, you know, obviously these folks are not in a position to pay fines or things with those lines. When we bring them before court, we can as a term of their probation hold them accountable to seeking out these services and doing different things. And it may even involve community service actually having [0:17:44, 0:18:00]: come in and help clean up these areas as a result of their violation of these offenses. So uh we want to handle those things, you know, uh in a in a fair fashion, uh taking into account again situations, but it definitely is an issue that I think needs to be addressed and [0:18:01, 0:18:12]: Uh thank you chief. Appreciate uh comments from the council. Yeah, just one right here, sir. Chief, I and I appreciate that. Y you know and one of the things that um we know about homeless is that [0:18:13, 0:18:18]: uh having a component to deal with the the mental illness that's gonna be out there because [0:18:19, 0:18:31]: repetitiously that's gonna continue to happen if you have those type situations. You push'em out here, they go on the backside, you push them out there, they go over there. And then you got this system of um [0:18:32, 0:18:52]: Just this cycle of s this you know, this merry-go-round system going on, I guess that's something that that's a greater problem than this ordinance that we're approving tonight. But hopefully we could, you know, address the mental illness that are going on out there that that when we start to move that hopefully the county and the cities can collaborate in a c you know, collaborative effort and start to get some [0:18:52, 0:18:55]: Some type of facility that we could take them to other than jail, you know? [0:18:56, 0:19:00]: Yeah there has been some discussion about that in that [0:19:17, 0:19:18]: Okay. [0:19:19, 0:19:30]: Excellent. Good deal. Thank you. Good deal. Any other questions, Council? Okay, I need a motion accept. Mayor, do I just say this real quick? Um approving the resources are the key, so thank you. Motion to approve. [0:19:30, 0:19:46]: Okay, sir Ms. Gantt, second that all in favor please indicate? Thank you very much. All right. Chief, I appreciate the presentation tonight. Uh thank you very much, sir. Thank you, Chief. All right. Uh Council of Consideration approved cultural arts uh center funding presented by Mr. Gardner, please. [0:20:07, 0:20:15]: I'm sorry, America. Uh can we get the chief back to the bottom real quick? Hey Chief, hey Chief, co could you come back please? [0:20:18, 0:20:21]: Hey uh got I got additional comment or question for you. Real quick. [0:20:26, 0:20:46]: All of us are dealing with the problem of litter in the community. Is the litter ordinance up to date or do we need to look at that? Because I I just see a tremendous problem all over the community with litter. Are we citing? Are we gonna be able to cite people? Is it enforceable? And at that point, um, you know, it just infuriates me when I go. [0:20:45, 0:20:51]: go down the road and I see a bag of trash just thrown out the window and it just seems like nobody's ever punished for that. [0:20:52, 0:20:58]: So we do have it's obviously it's a state violation, whether it's a state violation, we also do have a municipal uh ordinance violation on the books for that. [0:20:59, 0:21:05]: Okay, does it need to be updated or has it been reviewed or has that it it doesn't, it makes it illegal for [0:21:11, 0:21:21]: Uh all of our officers are and by the way I think they look really good in uniform. This is the first night we have our own stockbridge police officers in uniform in a council. [0:21:22, 0:21:24]: Yeah. [0:21:27, 0:21:40]: Race stuff. Uh they've already been provided with and they've they've they've gotten all the municipal violations, so our officers are clear on uh covered all the all the city where it has violations, so they're up to date on that and they're they're prepared to [0:21:42, 0:21:58]: Good deal. Thank you, sir. Appreciate it. All right. Yes, sir. I I'd just like to add a comment on for Councilman Alexander a couple years ago with the Don't Trash Stockbridge Initiative, which is a campaign against litter. [0:21:58, 0:22:18]: Excuse me. We did review uh all the ordinances and I think the biggest problem was enforcement. So I think now coming forward, uh we do have the the strong arms to uh to enforce all of those ordinances. And I just want to sort of mention that. Thank you, Chief. Great. Thank you. [0:22:18, 0:22:23]: Thank you Chief, appreciate it. Okay. Uh Mr Gardner, you're up, sir. Cultural Arts Center. [0:22:23, 0:22:24]: No. [0:22:24, 0:22:44]: Good night. Good night, Mayor Council. Uh two weeks ago you uh council asked for us to look at some funding priorities in terms of how to construct the uh cultural arts. Um with that we've come back with a list of [0:22:44, 0:23:04]: uh funding sources and uh three options for you guys support that um in terms of how look it potentially designed to be um cultural out center. So from the list of all the fundings we can recognize obviously general fund um which we do on an annual basis as part of our budgetary process. [0:23:04, 0:23:24]: There's obviously means the city's general fund cash reserves fund balance. It's also um a way to go. We have some a good amount of money in cash reserves. Um bond financing uh near open market over a twenty, twenty-five year period is one of the options that uh [0:23:24, 0:23:44]: For us in terms of funding. Uh Splash, which will come online in 2025, if approved by the voters, is a way for us to be able to also look as a funding source for Cultural Ad Center. It's also another way of being able to look [0:23:44, 0:24:04]: At and it won't be able to fund all of it, but certain portions of the building can potentially C D B G based on eligibility eligibility requirements, which this building is in the census track and potentially I was focused on the morning and um private sector funding. Um there are a lot of foundations out there that's new funding for [0:24:04, 0:24:24]: Arts and culture and performing arts, the Ford Foundation, Andrew W. Mellett Foundation, Officer Foundation, Andy Woodall Foundation, as well as the Robert Woodhoff Foundation. And those big applications we would put into those different foundations to fund [0:24:24, 0:24:38]: um if not all the portions of the room whereby all takes any cost. And obviously any combination of all of these particular funding sources can be brought in there in terms of funding the overall cost of the public. [0:24:45, 0:25:05]: So look where we are today. Today, the Public Facilities Authority did a 2021 series one in which we borrowed 14.865 million. We dedicated 11.1 million of that to the Western Cultural Art Center. [0:25:05, 0:25:25]: that we split off three million for piece of equipment. Then we borrowed an additional 2.9 series on B1. We made about three splash plus five for a total of about$14 million. So that's how much we have in the plus or minus because we've been actually working on the budget. [0:25:24, 0:25:30]: So we're out of 14 million models and we delicate so many modes that we're struck in our cost. [0:25:33, 0:25:53]: So where are we in the process? So we've gone past our concept variations we're now in the schematic phase. And that's where you guys were able to see where the building would look like in terms of different um variations of the building was presented to you guys by GSW. [0:25:53, 0:26:13]: Last month, and we chose I think the option was about 25.7 million dollars, which gave us a 11 million dollar funding gap. Um, and hence the exercise that you know go through tonight in terms of how people can potentially fill that funding. Um, but we're right now with schematic. [0:26:13, 0:26:28]: We still have design and government iteration, we still have construction documents iteration and construction document iteration by 100% completely that document, which means after that we can go to construction arguments. [0:26:40, 0:26:41]: Mm-hmm. [0:26:42, 0:27:02]: So option one in terms of funding, we would look at utilizing variations of funding sources. Uh if you take into account we really got our existing fourteen million dollars to$14 billion, uh to fix that the eleven million dollar gap um that can be funded on financing, uh repaid back to uh [0:27:02, 0:27:17]: Plus six is approved by residents. So you have to obviously pay the interest on the bond for at least up to one, maybe two years, through the jump fund. [0:27:19, 0:27:30]: And kind of almost like a pay-point format. [0:27:31, 0:27:38]: C excuse me, sir. Uh okay. Pay go format, what does that mean? I should know this, but what does it mean? So because you [0:27:39, 0:27:51]: Typically when you you have two options, you can go on a blue one to paint and construct it all at one time. We're bonding it, but because plus we won't get all of our plus money as one big lump sum. [0:27:52, 0:28:12]: We'll be paying our note over that four over that five year timeline, which is a five year splots, we'll be paying it over the five year pay as we get the money in. Okay. Okay, thank you. Obviously, um part of the presentation is gonna give you the option with also potential risk. [0:28:12, 0:28:32]: factors. Right? So we have two risk factors here. Obviously um loss six is a referendum. If it's not approved then that that sauce obviously goes away. So it's predicated on on the votes voting for. Um and if it doesn't pass that obviously the general [0:28:31, 0:28:45]: front of the beam, the only access point for you to be able to pay off the load, even if you're in the interest for high for a number of years, you still have to pay that cost. Um in the host of six. [0:28:46, 0:28:50]: And we have some obligations already coming in terms of [0:28:57, 0:29:17]: Option two, um utilize existing 14 million dollars um to continue the process through bond finance about six million dollars um to fund the gap repay that bond with futures plus funds um in 2026 moving forward we can utilize GDG money [0:29:17, 0:29:32]: I think it's up to$3 million as part of the ESG program at the CBG. Also, we can look at grant funding for about up to$2 million from those properties we spoke about earlier. [0:29:33, 0:29:53]: The heavy risk of that is once again six is going to be related on whether or not the folks approve it in 2025 or 2026. The other one is obviously repaying the back to the general fund. We already got it on the general fund obligations and LG in priority. [0:29:53, 0:30:13]: Um paying for a higher interest rate on the fund borough because where we are right now in inflationary time just enough, interest rate were just risen by the by the Feds. So we're now at 5%, just over 5% interest rate. Where we were last year was time in the Tuesday. [0:30:13, 0:30:25]: So we've seen a substantial increase in interest rates as long as we stay at 8% off, there's a bottom risk, potentially fair to continue to raise interest rates to slow down and [0:30:26, 0:30:46]: Obviously to use C D G funds will require us to ask Hemory County to approve the use of C D C D G funds because we're not an entitlement community. They are we are part of that reading of them. So we would have to ask for their permission to utilize C D BG funding under this because we're part of Hemley County's funding. [0:30:46, 0:30:53]: So obviously how we haven't put it there and watching it. [0:30:53, 0:31:00]: Um and then obviously um any grants will go forward to a foundation of the process is to be determined. [0:31:04, 0:31:05]: Got it. [0:31:05, 0:31:10]: enough and I think we have a comparative project. So it's a good idea in the future. [0:31:16, 0:31:18]: Option three. [0:31:20, 0:31:40]: Obviously, uh under this option, once again we have$14 million to be dedicated towards this project. Under option three, we'll literally be able to hold off on any bond financing uh for two to three years to get a handle on the bank project impact on the jump fund. [0:31:39, 0:31:58]: Borrow fund bond financing to see if inflationary subside, thereby the Federal Reserve lows interest rates on a short and long-term borrowing. So if those interest rates start to come down, obviously every time you bought to borrow money. You borrow a low, not borrow high. [0:31:58, 0:32:17]: Okay, Fred, let me let me interrupt you again. We say hold off on bond financing, or so otherwise we don't we just don't do anything else for two, three years, don't get any other bonds, just whatever bonds we have now, we just deal with that, nothing else. And so everything goes on hold across the project all the way across, is that correct? [0:32:17, 0:32:37]: Great. But we'll and and you'll see in the next slide kind of what I'm what that option three will inter inject. It won't be just a cold stop, but I'll get to the okay. Oh yeah, excuse me. So ahead please. Um cost of [0:32:37, 0:32:57]: construction is actually always in going up as most folks know um what it cost to build two years, three years ago is not what it cost to build today. Hence I think what you guys mentioned looked at$14 million or$18 million project and$25,27. And that still was a all we wanted. [0:32:57, 0:33:04]: on issues. The cost of construction, how's going to help, materials and going up. [0:33:06, 0:33:21]: And if this is the recommended item that's that the the council could vote on it, I would also open this option out for council to look at easy to do these things because that's going to be a good idea or general investments and a lot of time. [0:33:26, 0:33:46]: So usually under option number three, um when I said boy want me to start the process, we would literally continue to drive this, um moving the process to construction radios, which used to be a word called um shoveling. [0:33:46, 0:34:06]: We don't know exactly what's going to happen after November in terms of what happens in Washington, DC. But if it really needs a goal and potentially looking at future funding coming from public growth projects, and this will be the public growth project. If they expand, definitely. [0:34:06, 0:34:26]: Of eligibility, which they did in the CERS Act that expanded as in June 2020 through 2021. Out the funds being out of last year, they expanded some more, but that's going to be expanded anymore to allow the local governments and state governments to utilize more of those funds to give them off the books. So they'll need potentially. [0:34:26, 0:34:46]: So with this, we will get to construction documents and roll off at the end of the year to see what's going to happen. Um, in terms of it gives us about six months to see if inflation goes down or prices go down, we'll start to see interest rates over the feds go back on the interest rates. [0:34:46, 0:34:56]: rates. If they put back on an interest rate, obviously that attorney can borrow. They go to lock in attempts and borrow the funds. But at least we'll get the project to construct a ready. [0:34:57, 0:34:59]: If something changes to be very important. [0:35:01, 0:35:05]: They will get construction on board when we start construction probably. [0:35:05, 0:35:09]: You you your voice getting really low, Mr. Garner. [0:35:09, 0:35:27]: Okay, so on on this option three, if if the council selects that we we go to uh construction ready end of the year and it's automatically the recommendation will start for the feasibility study study will start automatically right away or what not? Yes sir. We we would there not submission council we would move forward trying to do [0:35:28, 0:35:35]: All right. All right. I'm pretty sure I I I like option three personally, but see what the rest of the council has to say. You wanna go first, sir? You're looking at me. [0:35:36, 0:35:38]: Mayor Ford Pro Tem. Okay, Mayor Pro Tem, go ahead, please. [0:35:39, 0:35:46]: Uh thank you. Uh I I do like the combination of two and three. Um [0:35:48, 0:35:55]: I feel that Bunding is a sticking point for this council. [0:35:55, 0:36:07]: Um and I think just looking at the um projections and projectors, it it may be valid. Um [0:36:10, 0:36:29]: I realize that the war in Ukraine, um the the pandemic, um I think has an effect on all of this. Um I think we've come a a a long way uh since twenty twenty. [0:36:29, 0:36:33]: Uh, we don't know how long the war's gonna go. Um [0:36:34, 0:36:54]: I I sort of feel that um it is going to uh sucide a little bit and I think things will be a little different. Um I would recommend that we continue to to move forward as far as uh uh community block grant funds. [0:36:54, 0:37:04]: um other grant funding, uh, just to keep it moving. And I do understand, counsel, about bunding, even though [0:37:05, 0:37:25]: I I feel that because of some other thing we could, you know, pay for that uh until uh the sparse pass and and I know I asked the question at the at the last meeting, historically, uh when has a bond fail and you indicated once and then [0:37:25, 0:37:32]: And it came back and it passed again. Um I have gone before the commissioners. [0:37:32, 0:37:34]: Uh as well as the city. [0:37:34, 0:37:54]: a couple of times uh with um block grant funds and and and and it has been approved, I don't see why um it would not um why the commission would not continue to grant this and I think we would have to lobby our two commissioners in the [0:37:54, 0:38:14]: the fourth and in the fifth to give us support. So the as I see it, the the sticking point is the bonding. I know I guess rightfully so the council may be afraid to to go into in addition to bonding since we're sort of already there and being able to to pay for that. [0:38:14, 0:38:29]: But m Mr. Gardner, what I would recommend, as you saw alluded to, uh to keep moving, uh, to look at the block grant finding, to look at other uh grant funding, uh just to be able to get to [0:38:30, 0:38:33]: a certain point, you know, construction point in the chart. [0:38:33, 0:38:53]: Um and and we'll see um about bonding later, but as long as we're continuing to to move to identify funds and that you alluded to, that eleven eleven million dollar window, which we're trying to achieve, and I just think that um by just going for [0:38:53, 0:39:02]: forward I I think we can um realize those sources to accumulate that eleven million. Thank you. [0:39:02, 0:39:03]: All right. [0:39:04, 0:39:06]: Any other comments? Go ahead, sir, please. [0:39:06, 0:39:26]: Yeah, I certainly want to reiterate my support for the project uh to move forward because it is an anchor in our downtown area that we want to make sure that we are committed to. The public should understand that we are very committed to substantial class A development, uh continuation in the downtown area. [0:39:26, 0:39:46]: I certainly agree with the support to uh to chase down C D VG funds that we are entitled to. I currently I really think in the last few we just we're not getting our fair share of CDVG funds. We're just not. So we're owed probably. [0:39:46, 0:39:56]: probably some excess uh C D V G funds uh for the city. So we wanna continue to to move down that path and to continue to look [0:39:57, 0:40:17]: Under every rock, uh Chick-fil-A Foundation, uh local organizations. We have a several big corporations that call Henry County home that we should look for, Home Depot, uh numerous other organizations that should uh be willing to pony up and uh when they see class uh acts come to the community. [0:40:17, 0:40:30]: We just want to make sure that we continue down the righteous path of moving the project forward and that it does not get stalled in and moving forward. [0:40:30, 0:40:50]: But you know the one the last thing that I want to say is this is a lesson for us all, okay? In and and and we beat the drum a thousand times when interest rates were low to take advantage of it. And I will say again, thank God we had the courage to bond the money for the police department. [0:40:50, 0:40:50]: Yeah. [0:40:51, 0:40:57]: The amphitheater and the cultural arts center when interest rates were at a historic low. [0:40:57, 0:41:17]: And they're well, they might never change. You never know when the war in Ukraine is going to come up or anything else might happen. So we just got to be prepared to understand it. This is what it takes in order to move forward. When you have a window of opportunity, you have to seize upon it because when that window closes, who knows? [0:41:17, 0:41:37]: Knows when it may actually come back. But again, reiterate to chasing those funds down, the CDBG funds. I certainly wouldn't be opposed to using some of the fund balance to help close that gap. That's what the cash in the bank is for, to be able to help us do that and to uh look at additional. [0:41:37, 0:41:47]: funding for all areas. I don't want to sacrifice any of the project or to cut any corners on it. So I'm certainly willing to do whatever it takes to move the project along. [0:41:49, 0:41:52]: Thank you, sir. Mr. Blatt, go ahead, please. I'm gonna [0:41:55, 0:41:57]: Mr. Gardner, thank you for that presentation. I'm I'm um [0:41:59, 0:42:02]: I think I'm in favor of of option three, too, and it's because [0:42:04, 0:42:24]: When this project first came to this council in 2016, you know, we dealt with quite a bit quite a few things. And in 2017, you know, just looking at this city, since I've been on this council, and I look at all the different names of buildings and everything around this council, around this city. [0:42:24, 0:42:26]: And when I was told about [0:42:27, 0:42:30]: Miss Carrie May Hammer's legacy. [0:42:30, 0:42:41]: And this it was brought to mean that this would be a good idea to name this facility after Miss Hambrick. I motioned to do that in twenty seventeen. [0:42:43, 0:42:55]: And in twenty seventeen, it was the focus was to build a nice, awesome facility with Miss Carrie May Hambrick name on it. And [0:42:56, 0:43:00]: During the course of that time and now where we are. [0:43:01, 0:43:10]: And when we did our bunding for projects that we had already put on the t not bunding, spLoss for projects we had on table on the table. [0:43:11, 0:43:14]: The p the police department starting it wasn't there. [0:43:15, 0:43:27]: And I just wanna make that clear. So that shifted because the starter police department, there's millions gonna be attached to it. Thank God we had the opera funding that could be shifted and different components in place. [0:43:28, 0:43:44]: But I'm for option three for another reason, is that when we look at this whole area, and I've said it before, you're not gonna do any construction in this area and not hit unsuitable soils and not hit rock. [0:43:45, 0:43:57]: So that twenty-five million is a foundation that's a car without any any extras when it comes to building, because we know, just like we got with that amphitheater, it's gonna be more than that. [0:43:58, 0:44:11]: But because I don't want us shortchanging what we've visited other uh uh cultural art centers and saw these nice cultural art centers. I don't want us shortchanging this one. [0:44:12, 0:44:14]: That could mean so much to this community. [0:44:15, 0:44:19]: that's gonna have someone that meant so much to this community on it. [0:44:19, 0:44:25]: It would be the first building in the city of Stockbridge with an African American on it in such a magnitude. [0:44:26, 0:44:27]: And so [0:44:28, 0:44:31]: I want us to continue to move. I would like for us to continue to move. [0:44:32, 0:44:35]: with the will of this council to get this project shovel ready. [0:44:36, 0:44:56]: But I also uh agree with my counselmates that I uh colleagues that I would like for us to look at other fundings and in and even with the changing of Congress, you know, uh you have you have arts the the arts funding that are in there that now we can apply for if it's shovel ready. That's certain different funding and grants uh uh that we can seek. [0:44:56, 0:45:16]: Especially once it's shovel ready. And so I like for us to continue to move in that direction. But I think this council is for me. I'm not gonna say this council. For me, I like for us to make sure that what we're going to be getting is going to be what we've seen in other cities, something that's top of the line and something that's also. [0:45:16, 0:45:21]: awesome instead of looking at cutting corners because we're trying to find another dollar. [0:45:22, 0:45:31]: I just want to make sure when we do it, we got the funding to do it, we got sustainability in place, and it's going to be a representation of the person's name that's going to be on it. [0:45:32, 0:45:52]: Um Ms. Gantt, go ahead, please. Thank you. Uh Mayor. Um I agree with Councilman Blount and the others um that have spoken already. Um and I I was gonna say the exact same thing. Uh we've always said this stoppage deserves the best. So this is an opportunity for us [0:45:52, 0:45:56]: to make sure we get the best um [0:45:56, 0:46:16]: I know that the option that is out here is that middle option, but we actually looked at the other the another option with all the bells and whistles, and it was even more than that. And hopefully when the price of building goes down, um and once we're [0:46:16, 0:46:36]: Able to receive grants and everything else, and we are financially able to construct. We will also revisit the way we want our art center to look. Um, I don't want us to settle just because we're trying to get a building up. Um, and I don't think we are settling just to try to get a building up. [0:46:36, 0:46:56]: Building up based off of what I've heard here, I think we all agree we definitely don't want to bond any more money right now. And when we look at um the CDBG fund just for educational purposes, um in the past, there were often times where none of the cities really utilized the CDBG, and StockRidge did. We used [0:46:56, 0:47:11]: some of our funds for sidewalks. However, um I just want Mayor and Council to be aware, and I don't know if we've checked to even see if we're el if that area is even eligible for C D B G. We have already. We are eligible in that area. [0:47:14, 0:47:34]: It is in the see okay. But when it comes to that, we just want to make sure that we're advocating um in a positive light to work with our county and hopefully um receive funds that we need. I I think that we should um do every single thing [0:47:34, 0:47:41]: thing that all the council members have suggested right now. So I too am in favor of option three. [0:47:42, 0:47:45]: Okay. Ms. Barber, I'm assuming you have comments as well. [0:47:46, 0:47:57]: I do support option three as well. Bonding additional funds is not an option for me, neither this time. That's all. [0:47:57, 0:48:14]: So I so on that note I uh so you look seemed like you got a consensus there, simple consensus e easily, not a unanimous decision. Option three is obviously the way to go. I don't know, do we need to make a formal vote on that? Is is or is we can just agree. Okay. Well if we're gonna okay, then I need a motion to accept option three. Yes, sir. [0:48:15, 0:48:16]: Um [0:48:16, 0:48:30]: Let me also mention, Mr. Gardner, and you you know this, but I just want to speak this uh for the record and for council. Um even with the uh museum and tourism. [0:48:30, 0:48:31]: Um [0:48:32, 0:48:41]: those hotel motel funds are available as well. Um I was not going to make a motion tonight. Um [0:48:42, 0:48:47]: um either one of them, I I think it's a consensus, Mr. Gardner, that [0:48:47, 0:48:49]: Uh, you will continue to [0:48:49, 0:48:54]: uh turn over the rocks. Um if there's not a motion [0:48:54, 0:48:56]: Uh to Bond [0:48:56, 0:49:01]: Uh s for example in um option two [0:49:01, 0:49:10]: Then I'm assuming that it's automatic, and you can correct me if I'm wrong, uh, that you will continue to um [0:49:11, 0:49:15]: research all those other options uh without um [0:49:16, 0:49:20]: any motions or whatever, you would just continue to do that. Um [0:49:22, 0:49:32]: I don't know if a motion is necessary'cause you know, unless you correct me, this is you know, you're going to research and identify these funding areas anyway, is that correct? [0:49:38, 0:49:58]: Uh co Councilmember Thomas, yes. I mean, we're gonna continue to to look for funding sources um as time move forward. Um if option three is is what is approved, I mean I would rather vote because then that gives us clear direction. Okay. Um versus way a vague direction. But [0:49:58, 0:50:10]: But I will say that, you know, we will look at all the different potential funding sources out there. Um and I will tell you, you know [0:50:10, 0:50:30]: I I I wish that the county would give us their their three million C D B G. They probably won't. Um, but um that's a conversation for us to have because we understand this is gonna be construction is probably gonna be a twelve twelve to fourteen month period. You know, that gives [0:50:30, 0:50:50]: gives us a a window, you know, the only thing is if we continue beyond, you know, one of the concerns we had is if we continue beyond the um the construction point, um, with the$14 million that we have in hand, obviously it's gonna come to an end as that money dries. [0:50:50, 0:51:05]: up if we don't we're unable to find any new sources of funding towards it and you'll have a half constructed building and that's something we don't want. So we're gonna work tirelessly to see exactly what's out there for us. Um even if it means us having to break away from the county. [0:51:06, 0:51:10]: And going through DCA directly because you get more money that way. [0:51:11, 0:51:13]: Um but that's also highly competitive. [0:51:13, 0:51:33]: um process but we'll investigate that as well. Right. Um we're gonna investigate we're gonna turn all the stones if that's the option to see what we can do in terms of making sure we could continue the process and bring it back to you guys before we get there. Right. So so mayor be before uh the motion and the vote, I I'd like to ask Carr, I'm just sort of curious if he would come forward [0:51:33, 0:51:53]: I just wanted to ask, and I know he's been involved in this for a while as far as material costs. So what is your experience as far as being able to see over the years from one construction project to the other over years and years? [0:51:53, 0:52:05]: how how that has swung back or has it sort of maintained the same? Does anything really go back to where it was or just [0:52:05, 0:52:25]: You just pick up and just continue to go forward. What what is your experience with with construction costs? Are you asking year over year what is the what has construction cost done as far as inflation? Is that your question? Yeah, you know, sort of where we are today we have seen'cause you know, we started out [0:52:25, 0:52:44]: uh at an$18 million project and it escalated to 32. And we know that because of inflation, the pandemic, the war and supply chains and all those kind of things. So have well I guess I should ask, have you seen any anything like this before in your tenure? But [0:52:45, 0:52:54]: Sort of want to know just based on your history, um, have you seen this kind of fluctuation in um building costs? [0:52:55, 0:53:15]: Fortunately, there is an industry uh publication called the Engineering News Record that tracks year over year inflation in the construction industry. Um it averages three percent per year over the long term, but obviously it does fluctuate quite a bit. Um I I will say this, and this is something that that [0:53:14, 0:53:34]: That is of concern as I have have watched you discuss the current trend, which is a significant year-over-year inflation rate, which hasn't been published yet, but I know it's probably going to be in double figures from last year to this year. Historically, there has not been a [0:53:34, 0:53:54]: Period of construction cost contraction with the exception of the credit freeze in 2008. We had a significant contraction in construction cost at that point. It lasted about a year and a half and recovered as soon as the economy started to recover. So if you're going to [0:53:54, 0:54:14]: To ask me what I feel like is going to happen going forward, whatever pressures that are causing the current inflation rate, when they ease, I would expect construction costs to plateau. I don't expect construction costs to contract. That has not been the case. [0:54:14, 0:54:34]: Case over you in history. The 1980s, we had a large inflation rate at that point. Construction costs didn't contract after that, it just plateaued. So I would expect you to keep that in mind as you're talking about when you want to start construction and trying to. [0:54:34, 0:54:50]: Trying to time the market. You're better off trying to time interest rates than you are trying to time actual construction costs. Cause I just would not expect it to come down. What we have done in this budget. [0:54:50, 0:55:10]: is uh allowed a three percent inflation to occur from the current construction cost to when we break ground. And that's just because three percent is the year over year norm averaged over time. Um and there's that we don't know if that's accurate or not. We don't know [0:55:10, 0:55:30]: what's going to be happening going forward and how quick the uh uh the industry is going to correct itself from what it's going through right now. Um but we have tried to allow for some of that. Now if the project gets ready to be constructed and of course we don't want to we don't want to stick a ship [0:55:30, 0:55:50]: Shove on the ground if you don't have it completely funded. As Mr. Gardner said, we don't want a project to have to stop. So year over year, as you delay the construction start date, you need to keep in mind that we're probably susceptible to additional inflation and not probably will. [0:55:50, 0:56:10]: not have any cost decrease occur. Thank you. Thank you, Mayor. Samuel do you have something, Mr. Blount first? Yeah. Thank you, sir. Uh call, you know, that three percent, I mean, that's pretty much out of the window for the last two years. It is. I mean that three percent [0:56:10, 0:56:20]: Um uh when you talk about the inflated price and you're talking about the cost of construction, on the two hundred fifty thousand dollar homes, people is paying thirty to forty thousand dollars more. [0:56:20, 0:56:37]: Which is way you know, so we I I don't even want this council even putting that three percent in their heads right now.'Cause that's you know, that's almost a cartoon. Uh one of the things that I want this council to to realize that when we talk about fourteen million identified, you can go ahead and double that. [0:56:37, 0:56:41]: At least twenty eight million is gonna be cost gonna be a cost on this amphitheater. [0:56:42, 0:56:48]: I'm just, you know, and and until we and I just want us to look at how do we identify that funding. [0:56:49, 0:56:54]: And once we identify that funding, this council has still has to remember there has to be sustainability on that property. [0:56:55, 0:56:57]: Those are the things that we hadn't even talked about. [0:56:58, 0:57:00]: So I think that we can do it. [0:57:01, 0:57:21]: And when we do it, I want to make sure we do it in a in a way that that that is built, that is, that is, that is a quality bill, and this and it's it's not a strain of sustainability, because we can't pull everything out of fund balance. We got so much in this city right now going on that we don't know what has fund balance is gonna have to sustain. [0:57:21, 0:57:21]: Yeah. [0:57:22, 0:57:37]: And so when we talk about building this this this building, we that three percent is out and I just think that we have to look at when I when I said shovel ready, I'm thinking about ground clearing. I'm not talking talk I w I wasn't thinking of erecting. [0:57:38, 0:57:42]: Because I wouldn't want us erecting starting to erect anything. [0:57:42, 0:57:48]: that would take the elements on until we get the other parts on it. I want this building to go up and come down at the same time. [0:57:49, 0:58:09]: You know, whatever whatever's gonna age, age. Uh when we piece off uh erecting constructions, um what are we doing? You know? I mean when we're ready to build, we're ready to build. I think that's what we that's where this council needs to put this project. When we're ready to build, we're just ready to build. We'll we'll put it up. [0:58:09, 0:58:18]: Up because they as they know, all we're gonna hear is, What are y'all doing with that? What are y'all doing with that? Why did you stop? Why did you know what's going on? When are you gonna get back going? [0:58:18, 0:58:22]: All of that. So I I just hope that this council when we're ready to build it. [0:58:23, 0:58:26]: That it's ready to build and is it's gonna go up all at the same time. [0:58:26, 0:58:34]: Not two or three rooms that needs to be done, you know, sit there just to let pe you know, just to appease what? It's not gonna please the public. [0:58:35, 0:58:37]: Mm Mr. Alzheimer, go ahead, please. [0:58:37, 0:58:57]: Let me say that I support the project a hundred percent and want it to move forward uh as quickly as possible. But I think Mr. Trebathan has said it right. Prices just don't go down. And it was you know, we had this discussion a couple of months ago. Well let's wait till when price prices plateau, the market resets itself. [0:58:57, 0:59:11]: And then but but we say this over and over again. The only way to beat the surge is economic development. We built the amphitheater for economic development. You gotta grow the pie. [0:59:12, 0:59:30]: At every opportunity when economic development comes to this city, new businesses, new jobs, the annexation, you grow the pie. And that way you bring in more income in order to help pay for this facility. So we gotta get in a mode where our mindset is. [0:59:30, 0:59:37]: Turn on the economic engine to bring in more money to the city at every opportunity. [0:59:38, 0:59:58]: When we can, bringing in new jobs, bringing in new subdivisions, bringing in new industry to sustain the city and to be able to raise the overall quality of life for the city. We we just gotta sing that song over and over again. Everybody up here, look for opportunities. [0:59:57, 1:00:17]: Opportunities to grow the revenue because as Mr. Trebathan has told us, contraction just generally does not happen in the market. I think 2008 recession, that was the first time that we had ever experienced some contraction. It was an odd oddity that just don't happen on a regular basis. [1:00:17, 1:00:18]: But [1:00:19, 1:00:39]: If you can increase that pie and make more money and deliver more for the city, that's what we need to be focused on up here. So instead of when developments come to us, when new businesses come to us, we got to turn on that. And it's the responsibility of every person up here to seek it every single day. [1:00:39, 1:00:59]: I want to build that culture art center now. I don't want to wait five years from now because in the end, what is going to happen is, as Mr. Trevathan said, the interest rates will go back down. The prices aren't going to go back down. But we got to be prepared ourselves when that window hits to act on it, activating increased revenue. [1:00:59, 1:01:19]: And the economic development. Thank you. On that note, uh council, I seek a motion for the cultural. I don't really know whether a a motion is in order in order for us to we've already directed the city manager to do what we want to do in order to do that. Does the motion [1:01:19, 1:01:39]: Really lock us into option number three when we might have economic development grow at a substantial rate. This really locks us into one of these options where there's no where we're saying this is what we're gonna do, we're gonna stall this project out, that's what's gonna happen. But if we give me [1:01:38, 1:01:58]: Mr. Gardner the direction to keep moving it forward without locking him into exactly this formula for number three, then we may be able to uh you know, circumstances may change. So I don't know if a motion is actually necessary when we can just give him general direction to move forward. [1:01:58, 1:02:07]: This how about I ask for op uh ask for a motion for option three. If it's no motion or no second, it it'll fail. Let me let me say this if you don't mind. Go ahead, sir. [1:02:07, 1:02:14]: Let me just explain this. You know, you you got five council members up here, you got five people with ideas. [1:02:15, 1:02:22]: The purpose of bringing options to get these five to agree to in some way or form to get a consensus on what options we're gonna go with. [1:02:23, 1:02:32]: And if option three doesn't pass, it doesn't pass. But that says that this council it in a in a whole had that option in place. If something changed, Mr. Garner. [1:02:32, 1:02:36]: That that that says, Hey, I know you guys did option three. [1:02:36, 1:02:42]: If it's voted for tonight, this has changed. This is in place. You bring that back to us. [1:02:42, 1:02:44]: But right now [1:02:44, 1:02:46]: We have three options in place. [1:02:47, 1:02:50]: And I'm motion for option three. Okay, is there a second to the motion? [1:02:52, 1:02:59]: I second what I have a discussion first. Okay. You want you you second the motion. I I do but I'll Okay fur further discussion. Go ahead, please. Thank you. Um [1:03:00, 1:03:01]: My question is [1:03:01, 1:03:07]: Does option three bind us to that that the design of the building here? Or is it [1:03:08, 1:03:12]: Is it's the middle design or will that allow us to just say [1:03:12, 1:03:15]: It's option three saying get shovel ready. [1:03:16, 1:03:17]: Yes. [1:03:18, 1:03:28]: Is it is going to be that's why you go all the way to the end of November uh end of dec uh November says stop here. In order to get shovel ready, we would have to vote on that particular building, correct? [1:03:28, 1:03:48]: Well you guys already chose the option which was to twenty five point seven. They're gonna go and design that building as we as you prove it. That's the one that you said. That was if we could get it now. We're not getting it now. So that's what they're going to the engineer, they're gonna bring that building to the PL owned [1:03:48, 1:03:54]: to do this higher a contract to do the stack construction limit. [1:03:55, 1:04:09]: Mr Mr Garner, it you know, um th that's kind of a wrench put in there because if if we're not doing something right now and we're gonna seek funding [1:04:10, 1:04:19]: Then that gives this council another option if we wanted to to move in a different uh you um s is something wrong, Ms. Car? [1:04:19, 1:04:39]: I'm I'm trying to you said something for the trend. So looking at the scale, what what option three does is bring you to a one hundred percent construction rate of that means I can take that off and and build it on that. I can take it higher contract at any point in the own. [1:04:39, 1:04:49]: Well I I I think option three if it was voted on was [1:04:50, 1:05:05]: It's it's a motion that's a good thing. But anyway, what I'm saying is if that if we're not talking immediate right now and and seeking funding, um for me personally, I wouldn't okay with option three, but I'm not the majority of the council, so [1:05:07, 1:05:09]: My motion made been seconds further discussion. [1:05:10, 1:05:21]: One more before I would draw my second. Because I I w I don't want the So you you here's my concern. What what is the estimated cost of us getting ups to shelvere ready? [1:05:22, 1:05:26]: Show ready about an hour twenty twenty five. I'm withdrawing my motion. [1:05:26, 1:05:35]: Okay, withdrawing the motion as well. Yeah, I'm with I'm I'm withdrawing my motion because I So motion's withdrawal. She withdraw a second. So I'll go ahead and answer the question, sir. Mr G Mr Gardner. [1:05:38, 1:05:45]: Well I think there is a consensus without a motion for option three. That's what I thought. That's what I thought. All right. And so but uh [1:05:45, 1:05:49]: Uh that that's that's my thought process. Mayor Ford. Yes, sir. [1:05:49, 1:05:50]: Mm-hmm. [1:05:50, 1:05:56]: I don't know what to say about it. I think I have a I'm sorry. Mr Mr Garner, um [1:05:57, 1:05:58]: One thing [1:05:58, 1:05:59]: Uh yeah. [1:05:59, 1:06:06]: Yeah, go ahead. I mean locked in that. Yeah, I wanna make sure y'all got y'all conversation together. I mean, I'm okay with that if y'all wanna [1:06:06, 1:06:07]: Hello. [1:06:08, 1:06:21]: Side if y'all wanna do a sidebar. I'm we okay with that. I mean that's that's what it's all about, if y'all need to do a sidebar. Yes, sir. No, we're good. Okay. Okay, so the twenty five point three is is is approved. That's not the issue. [1:06:22, 1:06:32]: Uh an and I think this is sort of a a no-brainer as well. I know you say you wanted direction from the council, but I I really think it's a consensus from the council [1:06:33, 1:06:35]: That you're going to go forward. Right. [1:06:35, 1:06:39]: There's no motion to to to do any bonding. [1:06:39, 1:06:40]: So [1:06:40, 1:06:42]: That's a no brainer, even in itself. [1:06:43, 1:06:46]: But it but the consensus is to go [1:06:46, 1:06:51]: And to identify resources, to identify grants, et cetera, et cetera. [1:06:52, 1:06:56]: That's the consensus. So I would think that when we leave here tonight [1:06:57, 1:06:58]: That is just what you're doing. [1:06:59, 1:07:01]: And then once you bring it back. [1:07:02, 1:07:20]: uh those identified funding sources, then we're moving. I I I I in my mind, you have a consensus to continue to go forward, to identify fund, to turn over rocks, et cetera, et cetera, et cetera. To me it seemed like that's all you need, you know, just to continue. [1:07:21, 1:07:25]: Now I you can correct me if I'm wrong. Yeah. True. But also [1:07:26, 1:07:29]: I don't because we i you know [1:07:30, 1:07:42]: All of these different funding options are predicated on others giving us the authority to get those funds, right? We know we have fourteen million dollars in the bank, plus or minus. Mm-hmm. Right? If I continue [1:07:43, 1:07:49]: And I go to and I get to November and we got a fully construction dark construction documents. [1:07:49, 1:07:51]: And I have no guidance to say stop. [1:07:52, 1:07:53]: We're gonna continue. [1:07:54, 1:08:04]: into construction. And then if we don't get any from if we don't get acquire any, we try and we fail, okay. You're gonna have a half built building sitting there vacant. [1:08:04, 1:08:05]: That's my concern. [1:08:05, 1:08:19]: Mm mm. I mean there's no guarantee. We we understand that because strongly as I feel that we have a strong project for potentially for f you know foundation and all of that, if Henry County don't give you any money. [1:08:19, 1:08:22]: That's three million dollars off the table, right? [1:08:22, 1:08:30]: I you know, if we don't get bond f if we don't get any foundation money, or we get some, but it's not enough to keep driving the process. [1:08:31, 1:08:38]: You see what I'm saying? We we're we're gonna have a hard start. But I thought we was under the assumption that we were not going to [1:08:41, 1:08:43]: Bio because [1:08:44, 1:08:58]: The the the funds are not there. Okay two so so in essence when if we haven't identified any continuous source when we get to construction, you guys are telling us to stop. Yes. Yes. Yes. That's guidance. That's all I need. [1:08:59, 1:09:00]: All right. [1:09:01, 1:09:02]: Play up. [1:09:02, 1:09:10]: Yeah, sir, go ahead, sir. This is just coming from being your program manager and knowing what to do. [1:09:10, 1:09:30]: And just understanding what you're what you're asking tonight. So the option three identifies funding sources. I think what's in question for me is, and it comes out of your question about the building, what building are we going to design? My question is: are we going to move ahead with the [1:09:30, 1:09:31]: Design. [1:09:31, 1:09:32]: That's what life. [1:09:32, 1:09:52]: That's the question. Because just point clear. Well what I'm saying is is that the option three, there's kind of there's an A and a B to that. A is you continue to design and get it shovel ready. B is you don't do any design, but you continue to look for funding sources for the project. I mean that's [1:09:52, 1:10:12]: That's what I want to know is tonight, whatever it is option for funding that you're looking to do, what am I supposed to do as far as continuing the development of the drawings and getting the drawing shot? I think continue on the drawings is what I think the consensus is, sir. Oh stand by. [1:10:12, 1:10:21]: I'm gonna go I'm gonna go to Mayor Pro Tem first. Go ahead, Mary Pro Tem. Cause are you asking are you asking about the the 25.3 [1:10:23, 1:10:25]: My question is [1:10:28, 1:10:48]: While you're looking for funding sources, are we to continue to get the drawings ready to build the twenty five point three project and have that shovel ready for when you have your funding in place to start? I would think so. I mean that's is i is that is that how the council is. Well that's what I think too. I think that's the answer. But uh [1:10:48, 1:10:55]: I think that's that's I think that's correct. That's the way I understand. Yes. And uh so that was your that was it. Go ahead, uh Mr. Alexander. [1:10:56, 1:10:57]: Do you have something to say, sir? [1:10:58, 1:11:18]: I was not trying to lock us in. You never know what might actually happen to or funding might come from or what might actually happen. So, you know, we we we sack we said we wanted to do the twenty five million so that we can move the project afford ahead uh, you know. But if we're not gonna start construction. [1:11:18, 1:11:35]: we might actually be able to go for the home run at a at the other at the top level and get everything. So I didn't w I didn't want to lock us in to any level amount'cause we might end up being able to afford it. The the the top notch where we want all the bells and wheels and build it at one time. [1:11:37, 1:11:46]: Go ahead, sir. And and I I I think what Mr. Alexander is saying and and correct me if I'm wrong, Mr. Alexander, is that's what I was trying to say. [1:11:47, 1:11:52]: If we're not going to build right now, start building and we're seeking funding. [1:11:53, 1:12:04]: Who is to say we can't get a better facility than what we're what we're looking at? See, cause right n for me, right now, I I would like to see a better top of the line facility. [1:12:05, 1:12:15]: uh coming in than what we have right now. And when you talk about the components of who's needed, what's needed, and I don't know uh what role you're gonna be playing [1:12:16, 1:12:20]: with Kek and Wood Carl, but in this phase I have no idea what role you would be playing. [1:12:22, 1:12:42]: Talking about during the construction phase? Not construction phase, because right now we're not even agreeing to start the construction phase. Right. So I'm working alongside the architect. Um and hopefully we would move forward and complete the procurement of the construction manager who will help us with developing construction cost models and help us with material. [1:12:42, 1:13:02]: materials and procurements and um forecasts, things like that. My job is just to pull all that together. So heavily involved in monitoring the the whole process, making sure we're designing it to the budget that we're talking about, um, and and being able to to answer to you that we're we're doing it. [1:13:02, 1:13:09]: Well, let me let me just point it. Design into the budget that's that's been out of the window. That's been thrown out of the window a long time ago. [1:13:09, 1:13:26]: Correct. I'm talking about whatever we're talking about a twenty five million plus dollar. That's to me, that's the budget, if that's what you say. And that's what my goal is, is for the team to develop this project within that uh within that that target amount. [1:13:28, 1:13:30]: All right. Anybody else? Ms. I'll go ahead, Ms. Gantt. [1:13:31, 1:13:32]: Okay. Uh [1:13:33, 1:13:53]: I agree with Councilman Alexander and Councilman Blount, and that was my concern. I'm just gonna say it. I'm not gonna beat around the bush. Basically, we would love to have the top-notch building, right? If we could. So if the cost right now is 1.4 million to get a shovel ready, what would be the cost? [1:13:53, 1:14:12]: cost to amend if we need if we were able to amend, if we found additional funding, um maybe maybe we're doing it wrong, maybe we're backwards, maybe that's not possible. What would be the cost for us I could be wrong. I mean, what would be the uh cost for us if we wanted to amend [1:14:12, 1:14:17]: to get that building that we initially all dreamed of or [1:14:18, 1:14:23]: Um you know, shovel ready, that is. Or you know [1:14:25, 1:14:33]: Once we if we pull the trigger now and say, Okay, yes, just go option three, get it shovel ready, spend one point four on these plans. [1:14:35, 1:14:45]: And we decide, you know what, we have funding now. If something happens, we get another s thing of ARPA funds or whatever the case may be. Um [1:14:46, 1:14:48]: Would we be able to change [1:14:51, 1:14:52]: Into the other option. [1:14:53, 1:15:11]: The answer to that question is yes. Um but right, we're talking about twenty million dollars on top of what we have in bank right now, fourteen million, to get to that thirty four million dollar build building. [1:15:12, 1:15:13]: Twenty milyen dollars. [1:15:15, 1:15:18]: I don't know we're gonna find twenty million dollars in a year, six months from now. [1:15:20, 1:15:25]: I I if that happens, glorious, crazy. But [1:15:25, 1:15:38]: twenty million dollars is what you're talking about when you say go and design the building to the thirty-four million dollar mark that they s presented to you guys, you're talking about now that funding gap is twenty million dollars. [1:15:39, 1:15:53]: If it's the Wisher Council, they'll design the building. It's gonna cost you probably another$200,000 to$500,000 or whatever to bring to get that building into engineering, but now you have to find that additional on top of to build it. [1:15:55, 1:15:56]: I mean and uh [1:15:57, 1:16:04]: Y you your your funding sources at that point in terms of what I produce here, the only way you're gonna get that is to go born finance the building. That's it. [1:16:06, 1:16:12]: That is it. I mean you you narrow down your choices when you add on top of that number. [1:16:12, 1:16:15]: And that's just being honest to to c to you coun council members. [1:16:16, 1:16:17]: So it [1:16:18, 1:16:25]: I get it. But yes, they they they can they can go ahead and they can they can bring you a construction ready project. [1:16:26, 1:16:33]: Right? Based on the thirty four million dollar option, it'll probably run us to two point two point something million dollars to do that. [1:16:34, 1:16:35]: Um but like I said [1:16:36, 1:16:38]: The back end of that course you just ballooned. [1:16:39, 1:16:41]: From from a construction standpoint. [1:16:42, 1:17:02]: Okay. Well we all know that the Art Center, this is a capital funding project. This is not something that's really revenue generated, right? We're doing this for the citizen for our constituents, um and for our downtown as another anchor building. Um I think this entire Marin Council is very serious about development. I agree that we have [1:17:02, 1:17:13]: to really focus on development in our downtown area. Um and um so having said that if we [1:17:18, 1:17:33]: If you if based off of your level of expert based off of your expertise, you're basically saying that the cost will be an additional twenty million there's a twenty million dollar gap there, you know. It won't go down, then [1:17:35, 1:17:55]: So be it. Then you know, I'm okay with option three. I just don't like settling for something. Um it still would be an it'd be a really nice building. I see it still has a ballroom upstairs, right? I I agree. I mean But if if what was the what features were taken off? [1:17:54, 1:18:08]: Let's let's talk about that real quick. That's remind me of those. That's kind of what I want to address when you guys are talking over here going, I wish I could talk a little bit. Um if you recall this version [1:18:08, 1:18:28]: has almost all your programming that you wanted in in the project. What we called out was a lot of the park features, the what we call the hood, the entrance hood was cut back. So there was a lot of things that were not programmatic to the building that was cut back to get [1:18:28, 1:18:31]: The balcony was cut, right? [1:18:31, 1:18:51]: That and I was going to get to the one things that you you won't be able to get back to is the balcony and the increased seating. That's the probably the one program item that once we start on this version, you would not be able to recover. But you would be able to add back some of those elements that we did. [1:18:51, 1:18:55]: call out without having to go back and redesign. [1:18:56, 1:18:57]: This this version. [1:18:59, 1:19:13]: So it is basically I I've never seen an art center without a balcony kinda like an auditorium maybe. I'm I'm just I just need like I I just don't know, y'all. I I don't know. [1:19:13, 1:19:20]: Mayor Ford. Ms. Block first, please. Go ahead. Um I [1:19:21, 1:19:23]: If it's the wishes of the council. [1:19:24, 1:19:33]: You know, I I just don't want us rushing into this like we have to make this decision happen right now tonight. When I think that [1:19:34, 1:19:38]: Some of us are looking at the fe the features in the places that we visited and we saw. [1:19:39, 1:19:42]: that w that I fell in love with. I don't I can't say to all of them. [1:19:43, 1:20:00]: It had the balcony feature. It had the stairs going up to the balcony feature. It had several features that really was classy. You know, that you can put a red carpet in. And you can put a red carpet out front without it getting wet because you don't have anything over it, the way this is gonna be built. [1:20:01, 1:20:09]: I think I think for me that we should seek funding. We should identify funding for it and we should build a top of the line cultural arts center. [1:20:10, 1:20:13]: And that don't look like it's happening tonight. [1:20:15, 1:20:17]: Okay, Mr. Alexander, back to you, sir. [1:20:18, 1:20:38]: Uh I d I I just uh wanna say, you know, again is that w the whole conversation began was was a vote necessary tonight. I I think I just the whole thing is I don't wanna bind us down to any of these choices right now. I don't think a vote is necessary. I think Mayor Pro Tem said that. So that's the direction that I would [1:20:37, 1:20:40]: want to go in is not to require a vote. [1:20:41, 1:20:42]: Mayor Portel, go ahead, please. [1:20:42, 1:21:02]: I I'm I'm going to agree with Councilman Alexander, but one thing I wanted to emphasize, Mayor, and I understand about the balcony, um, but what's still included and Carl, you can correct me, uh you talking about a museum, you're talking about uh you're talking about a theater and you're talking about a ballroom. [1:21:02, 1:21:02]: Mm-hmm. [1:21:03, 1:21:21]: We we don't look at these things as a corporation where you're looking at profit. I think in municipal government we're talking about surplus, but there will be revenues generated. Uh if you have a three hundred seat theater, three hundred seat ballroom [1:21:22, 1:21:24]: Those entities. [1:21:24, 1:21:31]: And the museum, this is what's going to bring folk downtown. And this is what's going to generate [1:21:31, 1:21:32]: Um [1:21:33, 1:21:41]: revenue and sustainability. So when when when Councilman Alexander talk about economic development, [1:21:42, 1:21:59]: and you have these entities that's bringing people downtown within a walking distance from the amphitheater to the cultural art facility, you talking about bringing thousands and thousands and thousands of people in your downtown. This is what economic development [1:22:00, 1:22:10]: developers, this is what they're going to see. They're going to see these entities that are bringing people in downtown and that is what's going to spur [1:22:11, 1:22:19]: All of the other things that are just going to happen up and down North Henry Boulevard, up and down Burke Street, M. L. King. [1:22:20, 1:22:22]: You look at the um [1:22:22, 1:22:42]: The battery, anything five or ten mile radius, they built simply because of that one entity. And I see the same thing happening here in Stockbridge with the amphitheater and the cultural arts facility. But I do understand about the balcony. So I'm I'm I have mixed emotions about that, but I do. [1:22:42, 1:22:46]: understand card that some of the um [1:22:47, 1:22:57]: water features, some of the landscaping, some of the planning. I know we can always come back and do that. Um so but I'm going to agree with Councilman Alexander. I just [1:22:57, 1:23:09]: I know once we start, you we we we may not be able to change that design. And so I'm a little conflicted with that. I I I love the balcony, I love the double staircases. So [1:23:11, 1:23:31]: This is where I'm just sort of conflicted, but I I don't want us to to stop. And that's when I sort of just thought that um the funding sources could still be sought all at the same time that the 25.3 design was still going in motion. [1:23:30, 1:23:33]: What you was alluding to, uh uh Mr Alexander? [1:23:36, 1:23:55]: I I didn't want us to get locked. I just really just don't want us to make that decision uh right here tonight, locking us into what's going on. Uh you you had indicated earlier that you did not think a motion was necessary. I don't think emotion is necessary either. And and I still agree with that. So let me ask [1:23:56, 1:24:01]: Mm mister Gardner, so if no motion is made and call if no motion is made tonight [1:24:03, 1:24:10]: What is the confusion I I guess on on your part if no motion is made tonight? [1:24:11, 1:24:23]: First of all, let me clarify the balcony is in this version. It's just a smaller floor seating that we took out. The overall seating was reduced and that would not be able to be recovered, but the balcony is in this [1:24:24, 1:24:29]: The dual staircases was removed too. One of the staircases was removed. So it's [1:24:29, 1:24:48]: Which is actually a recommended design feature from the architect was to only have one stair, but nevertheless. So to answer your question, it's really just whether or not we're going to move the design team forward with developing the design. Um [1:24:50, 1:25:10]: With with the with that basic concept. It's not saying that concept can't be enhanced if you have additional funding to put back in some of those features that were taken out or reduced. But the building mass, you know, the way it's constructed, where the rooms are, where all the seats are. [1:25:10, 1:25:12]: [5113.9, 5120.0]: So Mill, if I may answer this question. So so s where are we now in that design um [1:25:21, 1:25:24]: I think the last time we spoke with uh Mrs. Hubble. [1:25:24, 1:25:27]: And uh well, when we had the [1:25:28, 1:25:36]: three twos, I believe it was, and the consensus was the twenty-five point three. So from that time to this time, [1:25:36, 1:25:40]: So where is that design? Have we crossed [1:25:41, 1:25:43]: The line of no return or [1:25:44, 1:25:46]: Uh, we hadn't gotten to that that point yet. [1:25:46, 1:26:01]: The architect hasn't done any work on the project since the discussions were held about which design you w that which version that you wanted to do. There's been no no other work's been done physically by the architect on the design. Okay. [1:26:03, 1:26:03]: Yeah. [1:26:03, 1:26:10]: All right, so no the work's been done on that. So they're really just waiting for direction to to move forward. [1:26:10, 1:26:23]: And our direction is to get additional funding and get to the construction phase, I guess in November as you outline on a slide there, stop right roughly in November. Get it shoveled ready, is that what is we call it? [1:26:24, 1:26:24]: No. [1:26:25, 1:26:29]: Yes, based on which concept. Because what I heard was [1:26:29, 1:26:47]: Let's go for the things we want, which is the thirty four million versus the twenty five point three or seven w which I mean,'cause they need to know what they're what they're designing. Um, if that's the case, we need to know that. I mean [1:26:47, 1:26:50]: That's what council wishes to go for then. [1:26:50, 1:26:53]: That give us that direction so they can start [1:26:54, 1:26:57]: The architects could start moving on designing that that building. [1:26:57, 1:27:03]: Well, I thought the twenty five million was was fine w fine with me, but obviously the rest of the council's gotta weigh in on that. But anyway. [1:27:06, 1:27:08]: So we're stuck here, it seems like, but we gotta make a decision. [1:27:09, 1:27:10]: Yeah, we're stuck. [1:27:10, 1:27:30]: I I'm I'm okay if there's a balcony, right? And if the other parts of the design can be changed as stated. You were saying that there were some certain things that we wouldn't be able to change, but the majority of that with the thirty two million dollar one, the the things that we took off were [1:27:30, 1:27:50]: possibly things that were outside, was that not? Like the water feature park, all that good stuff, or or was it and maybe one green room or some some kind of room, um a classroom that was I if I don't recall correctly. If if you if you move us [1:27:50, 1:28:01]: forward with the design and you've seen the way the building is laid out, the floor plans, the elevations, that's what they're going to design. [1:28:02, 1:28:03]: Um [1:28:04, 1:28:12]: So that really won't be able to change. The cause they're gonna design the b the balcony, the seating, you know, the whole theater house gonna be designed. [1:28:13, 1:28:26]: All the rooms, all the features within the building will be kind of locked in in once we get started. What can change is is how much you do outside the building in the um in the the park areas or [1:28:27, 1:28:32]: to the I was mentioning like the the the hoods, which is the [1:28:33, 1:28:53]: Overhangs, they should be as you approach and you can do it. We took out the one in the back, we diminished the one in the front. Those can be redone, they can be expanded. The park can be put back in, all the water features, all that can be put back in without affecting the building. It's just we can't affect the building itself once we get started on it without incurring significant. [1:28:53, 1:29:13]: Which is the inside inside of the building, which you refer to. You're not going to get back to the concept of the 32 million if you decide to change in because that was just configured differently. The whole building was configured differently. But the program that we that is in the 25 million project, all those rooms. [1:29:13, 1:29:17]: that's what you're gonna get and and you're gonna you're gonna be locked in to to that [1:29:18, 1:29:19]: Yeah. Yes, sir. [1:29:20, 1:29:21]: E muh. [1:29:22, 1:29:23]: When this [1:29:25, 1:29:30]: This one was voted on. In my opinion, the rooms was pretty small. [1:29:31, 1:29:41]: for what we thought we was you know, for what I thought this council wanted. When you guys talking about refiguring ref you know, doing some refigurations of the building. [1:29:42, 1:29:50]: That to me was kinda outside the lines of what we've always looked at and what we thought we was getting. I thought that that's what this council wanted. [1:29:50, 1:29:56]: When we talked about some other th something else that's in place that we needed to take care of in order to make this happen. [1:29:57, 1:29:59]: I thought we was gonna do that. [1:29:59, 1:30:01]: Prior to getting to this point. [1:30:02, 1:30:06]: And I thought that's what this council wanted, but obviously we haven't got to that point. [1:30:07, 1:30:22]: So so much have have brought this project from what we saw that gave us glitters in our eyes to how can we piece it off and start and make it happen. And I'm not I mean, if this council vote on it, that's fine. I respect that. [1:30:22, 1:30:42]: But I'm not for us doing that because what we saw and what we knew that we wanted downtown, this developing downtown area that we're we're trying to build was not what we're doing right now. And it's not the interests and exits are not what we wanted. It just w [1:30:42, 1:30:51]: We're trying to make something happen that was not the vision of this council. But but if this council votes to move that forward, I would respect that. [1:30:54, 1:31:08]: All right. So we okay, we still still need direction though. You know we're gonna get f additional funding. All right, so uh that that that is uh that is a go. And Mail I got one last question. This is the question. Go ahead, sir. Uh [1:31:10, 1:31:11]: They [1:31:12, 1:31:22]: outside features, water features, the landscape and all of that. Uh that could be done later, correct? Uh the the hood I know [1:31:23, 1:31:25]: I know we have to start um [1:31:26, 1:31:31]: put the the rendering in place now for the hood and for the back and all those kind of things. [1:31:32, 1:31:35]: Um and I'm not gonna ask you at what cost, but [1:31:36, 1:31:38]: It seems that if we could [1:31:39, 1:31:46]: Stay with the cause originally when we we when we saw the the eighteen million. [1:31:46, 1:31:47]: rendering. [1:31:47, 1:31:53]: It had all of the bells and whistles. It had the the balcony, the double stack, so it had everything. [1:31:54, 1:31:55]: So [1:31:56, 1:32:05]: If we now agree to still put all of that in so you could go forward, but to exclude [1:32:05, 1:32:08]: Those things that we can do later. [1:32:10, 1:32:17]: I and I'm trying to get in my in my mind w a at what cost will we be looking at doing those things? [1:32:17, 1:32:32]: And coming back with water features and all the other stuff later if the finances is there. Because seeing like what I'm hearing that we d we still want all of the bells and whistles. A am I correct that we still want the the balcony, the the double stacking? [1:32:33, 1:32:48]: That's what we we still want all of those things. Is that correct? I can't see down through that, but seems to that's a general consensus, yes. Okay, and and and the things that we could do later as far as landscaping, water features and [1:32:48, 1:32:56]: It just seems that, you know, we can sort of just come back and do that, but we but we won't and I do understand what you say once you [1:32:56, 1:32:58]: do a a blueprint [1:32:58, 1:33:12]: That's how it's gonna go up and you can't change that once you get halfway, you can't change it. So it just seems that we we can approve all of the bells and whistles, but eliminate [1:33:12, 1:33:17]: all of the features that we can bring back later and I don't know if we saw the [1:33:18, 1:33:38]: Are we talking apples to apples or we talking apples to oranges when we say we'll bring back all of the exterior, you know, landscaping water features and and all of that. So does that sort of does it make sense that we can still sort of go forward with all of the bells and whistle with the balcony, the double staircase and blah blah blah and [1:33:39, 1:33:42]: Does d does any of that make any sense? [1:33:42, 1:33:46]: Did that give you any indication of moving forward? I guess that's the question. [1:33:48, 1:34:08]: Obviously you gotta notice it I would say it's gonna be more money, obviously. Yeah, so yeah, I'm trying to really formulate a really good answer answer here. Anything that you do, we'll call it as a second phase to put in things later, you lose uh the economies of scale. [1:34:08, 1:34:28]: scale so that second project in itself will cost more just because of the you're losing economies of scale. You got a separate project, a separate overhead, general conditions, things like that. So there's a premium to doing anything beyond the end of the first phase. Um but I I don't [1:34:29, 1:34:35]: If you're really talking about wanting to do that, I mean that's still a good viable approach. [1:34:37, 1:34:57]: The concept that you've looked at and that the 25 million does exactly what you said. We called out a lot of things that could be done later, and those can be done later. Now there were some other things that we called out that I've already talked about, but you know, I w wanna reiterate that the balcony is still in, so you're not you're not [1:34:57, 1:35:16]: not asking us not to do the balcony and doing it later. It's it's in the project if you approve this twenty five point. So the balcony is in the twenty five point three? Yes. But only but one staircase. One staircase. And again, the architect really believes that's the right answer d given the way the that lobby works, that that is actually the [1:35:16, 1:35:36]: Wasn't that balcony reduced uh from the original uh possibly. We No it No, I'm I'm saying it was. It was re it was reduced from the original drawing and then you put guys put one staircase in there and when we continue to sit here and say what we can do later, do later means we don't have the money to do what we wanna do right now. [1:35:36, 1:35:43]: And I'm asking this council that we f identify funding, get those monies in and build what we want downtown. [1:35:44, 1:35:54]: Because piecing this and piecing that, it only means we don't have the money right now to do what we wanna haven't identified the monies right now to do what we wanna do. [1:35:54, 1:36:05]: And I just say if we're gonna build a project, put the face put just build a project. If we start phasing this thing off, it's gonna cost us more than more than we're bargaining for. [1:36:05, 1:36:09]: And it changes the it changes who's liable for whatever's not done right. [1:36:12, 1:36:23]: So m so to do landscaping and water features now well later, is it gonna cost any more to do it to put it to do it [1:36:23, 1:36:34]: I guess in and it can can the design for water features and landscaping can that come later without a substantial increase in the cost of the overall project? [1:36:35, 1:36:55]: Well, I know we I know all this is how it's substantial, but yes, there will be a there will be a percentage of cost increase because of the economies of scale. But it's well I'm I'm gonna listen to t to whatever recommendation my council makes down on the other end wanna do. I'm gonna start okay so we can c so we can close this one out. Just one last thing. From the original [1:36:54, 1:36:57]: design that we looked at and we wanted. [1:36:57, 1:37:01]: This whole building and this whole project has shifted. [1:37:01, 1:37:02]: Mm-hmm. [1:37:02, 1:37:05]: to fit in areas that we didn't really that we didn't [1:37:06, 1:37:08]: We're trying to make something fit. [1:37:09, 1:37:22]: Because that was a direction this council was going where we that I would hope that we would get on back on track to go. What we saw in the entries and exits, all entrance into the facility, exits out of the facility, all of this stuff. [1:37:22, 1:37:23]: Is what we wanted. [1:37:24, 1:37:27]: And if we identify the funding, we can still get it. [1:37:28, 1:37:30]: We just have to we don't have to rush and do this tonight. [1:37:31, 1:37:33]: Let's identify the funders and be o what we want. [1:37:34, 1:37:37]: We don't have to piece it off, we wouldn't have to do all this stuff. [1:37:37, 1:37:41]: There's nothing nobody there's nothing that says we have to do that do this right now tonight. [1:37:42, 1:37:47]: Our city manager say he's gonna identify funding. Let's go back to what with this council said we wanted. [1:37:47, 1:37:51]: Just like we did with that amphitheater. It ended up costing us more, yeah. [1:37:52, 1:37:58]: Because we don't we never built one. We didn't know we were gonna come into those problems. Let's build w what we want in this city. [1:37:59, 1:38:17]: And what we're talking about building right now is not what this council has sat down and said we wanted. We didn't say we wanted a little small bathroom with one stairway. We didn't say we want to put this right here and then don't have to overhang. We didn't say we want to shift where the building is going and now we gotta deal with parking in a totally different way, in and out. We didn't say that. [1:38:18, 1:38:20]: But when these councils sit here trying to make something happen. [1:38:22, 1:38:26]: Then let's just identify funding and get what we want. What's wrong with that? [1:38:27, 1:38:47]: Yeah. Go right, sir. Uh I I I could agree with that and to just say that, you know, we had we we the entrance off North Henry Boulevard, right? That was part of what was cut. So the the entrance is gonna be on Burke Street. There's no no entrance off of North Henry Boulevard. So there's so many things that we [1:38:47, 1:38:58]: we have regressed on. But what I wanna say is I wanna reiterate what I said at first that no vote should happen tonight. We don't wanna do that. I I will agree with that. [1:39:00, 1:39:20]: Any other agreement about that as well? I guess you withdrew it. You withdrew it. Well, I I I I didn't I don't like that design anyway. So the twenty five million dollars? If my motion was that design, that's why I would pull back my motion. I don't think there's any motion that could be done tonight anyway. This city deserves a lot better than what we give presented tonight to be in. [1:39:21, 1:39:41]: All right. So Icelandist three says no motion uh no mo motion needs to be made, but you have verbal guidance here, Mr Mr. Uh Gardner. And Carl we gave you the best guidance we possibly could at this point for where we're going in this aspect. And Miller, if I could say if w I I think we can continue to discuss um you know [1:39:41, 1:40:01]: Offline and maybe by the next meeting we may have a better uh understanding because Mr. Garden know I'll be calling him in the next couple of days and call I may call you as well uh to make sure we got a better understanding. But we definitely want to make sure uh that we do end up. [1:40:01, 1:40:21]: Up with uh the project that we really want, even if it takes a little longer uh to to do it, but we definitely want the uh the right project. So I'm in favor of not voting tonight. And Mr. Garner, just know that we still look for you to [1:40:21, 1:40:41]: go and identify uh funding sources, grants, et cetera, et cetera. And and we'll just continue to talk and make sure that um uh you know we'll try to get folks who are doing the design, give them some kind of directive i in the next f four, five weeks so we can sort of just, you know, get that going back again. [1:40:41, 1:40:52]: All right. There's no other comments on that. No, we're gonna move on to the next subject. Okay? And that would be council consideration to approve the amphitheater rental policy. Mr. Gardner. And uh Carl, thank you for your time. [1:40:55, 1:40:55]: Mm. [1:40:55, 1:41:00]: Mayor, if I may again, um it it seems that um [1:41:02, 1:41:10]: At this mic here, and it maybe something that we can do at a later point, but uh madam clerk, folks cannot hear the presenters. [1:41:10, 1:41:16]: Uh when they come in, I don't know if it's the system there, but they they cannot hear the presenters. [1:41:18, 1:41:22]: I w we'll probably have to get IT folks on that one as well. [1:41:23, 1:41:43]: She'll see what she can do. She's going back to check it out now. Great. Go ahead, Mr. Gardner. Talk to as loud as you can, sir. So hear you. Rental policy for ampathy, sir. Yes, sir. Please go forward. Um stop bringing to you tonight, Mayor Council, uh a draft version of the policies that would guide uh the use. Wow, that was pretty good. [1:41:43, 1:42:02]: Uh the use of the uh amphitheater, um looking at days and hours of operation, reservation procedures, um fees and payments, um cancellation, indemnification, safety and security, um just going through all the areas that the policy covers. [1:42:03, 1:42:07]: Um the use and maintenance policy as it relates to the amphitheater. [1:42:10, 1:42:17]: Advertising sponsorship, concessions, traffic control, parking, guests rules and regulations. Um [1:42:21, 1:42:22]: And uh [1:42:24, 1:42:30]: You know, with that we wanna take any questions that you guys may have. Um, but I understand that it is a draft, so any [1:42:31, 1:42:35]: Any recommendations you would have now would be great. Um [1:42:36, 1:42:56]: And uh we'll make those necessary changes. It is a draft document that we bought put in place here tonight for you guys to review. If you feel like it's something we can move forward with, we'll move forward with with the understanding that obviously it's a policy document and any time we can see areas to improve we will improve or as we make changes to any potential fee scale. [1:42:56, 1:42:58]: schedule, we'll be able to do that and bring that back to you. [1:42:59, 1:43:01]: Okay, comments. Who wants the first? [1:43:02, 1:43:15]: Mayor Ford. Go right into the please. Go ahead, Mayor Pro Temp. Uh Mr. Gardner, you and I spoke earlier about um this particular document and [1:43:17, 1:43:23]: One or two concerns I had, even though you you sort of answered some of those, I wanted a [1:43:24, 1:43:30]: A provision where the elected officials [1:43:30, 1:43:44]: uh could actually use um the facility, the green room and or the amphitheater and you and I sort of spoke and you sort of suggested some things. So I would like to reserve [1:43:45, 1:43:48]: And maybe other council members may [1:43:48, 1:43:52]: after the meeting tonight to get with you and and and to put that input in. [1:43:53, 1:43:54]: And I was send out something. [1:43:55, 1:44:10]: just explaining, you know, uh my recommendations for a provision that where elected officials could actually use it because the way it states right now, uh there is not a provision for that. [1:44:11, 1:44:14]: And I also had a concern about [1:44:14, 1:44:15]: Um [1:44:16, 1:44:18]: Third parties. [1:44:18, 1:44:20]: And so um [1:44:21, 1:44:41]: I've sought to express those things and I will um in the next couple days uh send something out to the council as far as uh some of my concerns and some of my recommendation. And I just thought of just leave it at that. Uh it is a working document as you indicated and uh [1:44:40, 1:45:00]: Uh I just wanna be able to um just to share my recommendation to the to the full council. The fact that, you know, we were out of town and just didn't get a chance to submit those, but uh in going forward I will um share my recommendation to the full council. [1:45:00, 1:45:05]: Sir. Thank you. Go ahead, uh Mr Alexander. [1:45:05, 1:45:25]: I support those recommendations in terms of allowing uh mayor and council to use the green room as we do any other facility um in the city. Of course, that requires council approval to use Merrill Mendes or anywhere else uh for a particular event. Certainly that's in keeping with what we're doing. But this is urgent. [1:45:25, 1:45:32]: We need this agreement passed so we can rent this facility up. Every day that it's empty, it's a problem. [1:45:33, 1:45:53]: We we cannot continue to go down this line. We have people seeking to rent the facility and we have nothing in place in order to do that. You know, obviously this can be uh changed if it needs to be, but if the legals looked at it already, it's the going rate. We need this amphitheater to rent it every day. [1:45:53, 1:46:13]: rest of the year. So what it is it that we need to do in order to go ahead and move this forward. Obviously uh some iterations can be uh ex uh uh d uh changed certainly we got the youth council facility we had uh I think we got working on Hispani Fest too right Mayor? That's correct October first [1:46:13, 1:46:24]: Scheduled date. Scheduled days October first. Okay, so those events and those people need they need certainty uh amongst themselves. So I I think we should go ahead and move forward with it. [1:46:25, 1:46:26]: Okay. [1:46:26, 1:46:32]: Any other comments from the council? Yeah, Ms. B uh Barber, go ahead please. I do have a question in regards to [1:46:33, 1:46:35]: The guidelines on [1:46:37, 1:46:38]: When [1:46:38, 1:46:39]: B [1:46:40, 1:46:42]: Amphitheater rental policy. [1:46:42, 1:46:43]: Would be used. [1:46:44, 1:46:45]: Who determines [1:46:46, 1:46:48]: What is what are events? [1:46:49, 1:46:50]: And what are concerts? [1:46:52, 1:46:56]: Who would determine that and what criteria would be used? [1:46:56, 1:46:59]: To determine it. [1:47:00, 1:47:03]: What guidelines or criteria would be used to determine? [1:47:04, 1:47:05]: What is considered [1:47:06, 1:47:06]: An event. [1:47:07, 1:47:07]: Or concert. [1:47:08, 1:47:10]: Because anyone could [1:47:10, 1:47:11]: Complete. [1:47:11, 1:47:13]: A rental application. [1:47:14, 1:47:15]: Correct. [1:47:15, 1:47:16]: Right. [1:47:16, 1:47:17]: So [1:47:17, 1:47:18]: Who determines? [1:47:19, 1:47:21]: Веде із Нівен. [1:47:21, 1:47:22]: Or a concert. [1:47:22, 1:47:24]: Oh, whether or not [1:47:25, 1:47:28]: their activity, whatever it is, event or concert. [1:47:29, 1:47:31]: Whether or not the management company [1:47:32, 1:47:35]: would actually manage their event. [1:47:37, 1:47:39]: What criteria or guidelines [1:47:39, 1:47:41]: are in place or how we determine that. [1:47:42, 1:48:02]: So if when we when we bring on a management company, that management company obviously will be guided by the contract in terms of, you know, them bringing the acts during the concert series between June or or May or April and and say September. Um they will obviously be booking. [1:48:02, 1:48:11]: Those acts for use in the in the specific slot times that they identify for those acts. As it relates to [1:48:11, 1:48:17]: to the use outside of those within the gaps when those concerts aren't being done. [1:48:18, 1:48:22]: Uh this policy will guide as well as the application that says, you know [1:48:22, 1:48:26]: What do you want to use the app the build you know the use of the building for a concert? [1:48:27, 1:48:36]: you know, for a down something, uh what you know, whatever is in there and then the fee structure will apply. Um that's Who determines that? Say again. [1:48:36, 1:48:38]: Who determines that? [1:48:39, 1:48:40]: Who determines what [1:48:40, 1:48:45]: Who determines whether or not it is classified as an event? [1:48:46, 1:48:47]: Or concert. [1:48:47, 1:49:03]: Well, the the person that wants to rent it will come to us, fill out the application. I wanna use this for a I wanna use the amphitheater for a concert or I wanna use the amphitheater um [1:49:04, 1:49:23]: I guess for a show and tell of of my business or whatever. I mean they'll put that in the application, we'll charge them the applicable fees and all of the associated um uh uh requirements will apply. That'll be we looked at administratively. The staff will look at when they fill out the application, that will be approved administratively. [1:49:24, 1:49:24]: Okay. [1:49:25, 1:49:28]: I asked for a copy of the application I wanted to see. [1:49:29, 1:49:31]: Is staff still drafting the application? [1:49:32, 1:49:48]: So yeah, so we have a we we we've got a draft contract that we're working on in terms of the of the use the application, we're still drafting that. But that I would assume that y'all don't wanna see an application. I mean that the policy is was legislatively [1:49:49, 1:49:58]: dictates regules and regulations. The application is something you do administratively. Well and the reason why I'm asking again because of our current situation. [1:49:58, 1:50:03]: We have a management company that has exclusive rights. So if a [1:50:03, 1:50:05]: Entity or business. [1:50:06, 1:50:10]: Whatever wants to have a show at the amphitheater. [1:50:11, 1:50:19]: If they complete an application, who determines whether or not it is classified as an event? [1:50:19, 1:50:28]: Your staff. Or that's i y your staff will u will determine whether or not that event is in keeping with the policy and the use of the amphitheater. [1:50:29, 1:50:30]: That's done administratively. [1:50:32, 1:50:36]: But our management company has exclusive well right well realize [1:50:38, 1:50:44]: Young the the management company has some predetermined dates under the current twenty two [1:50:45, 1:50:45]: schedule. [1:50:46, 1:50:49]: Outside of those twenty twenty two scates. [1:50:49, 1:50:51]: They have informed us that [1:50:51, 1:50:57]: That that notation in the section that says they have exclusive, they're not going to enforce that and they have not. [1:50:57, 1:51:01]: Enforced it, as far as I know, they haven't. They've said it numerous times. [1:51:01, 1:51:03]: Today will not enforce that provision. [1:51:04, 1:51:13]: Um, this guiding document will guide us beyond this current twenty two what's left of this twenty twenty two series. It'll guide us moving forward beyond that into the future. [1:51:13, 1:51:29]: Okay, so So as it relates to any events that we are doing the fourth of July, they've already told us they have no problem with us utilizing the the facility as it relates to that, to those dates and times and the August event. [1:51:33, 1:51:36]: Sir, you go ahead please. Yeah, I think uh [1:51:36, 1:51:56]: You know, you have a valid point, Ms. Barber, in terms of going forward. Uh that language does need to be added to uh the next contract, no matter who it is. Any date that this provider does not choose certainly will be available to the city to use at our discretion. But it was good to see Mr. Young come to the [1:51:56, 1:52:16]: podium and categorically state he had talked to Mr. Murray that uh they had waived that right. So uh you know they got their 12 dates for the year, pretty much everything else. And I'm imploring this council to get this facility rented out. So based on that, I certainly would like to [1:52:15, 1:52:35]: uh go ahead and make a motion to approve this uh agr rental agreement with the contingents that the council would be uh allowed to use the facility for uh for the green room and the facility itself with approval by the council by the uh council. You bring it just like you do to Merrill Manders or any other facility. [1:52:35, 1:52:36]: Is there a second to the motion? [1:52:39, 1:52:40]: Is there a second? [1:52:41, 1:52:42]: to Ms. Alzheimer's motion. [1:52:43, 1:52:45]: I don't have a second, but I do have [1:52:45, 1:52:49]: Follow up comment for me. [1:52:49, 1:52:51]: Hm. I I was second. [1:52:52, 1:53:09]: based on the and and if I heard the mo it's very hard to hear down on this end, uh Mr. Alexander, is your motion to accept the policy as written with the addition of a provision for the elected body to be able to use? [1:53:09, 1:53:10]: That's correct. [1:53:13, 1:53:15]: Upon approval of the council. Yes, sir. [1:53:16, 1:53:18]: I was I was second that. [1:53:18, 1:53:25]: All right. Motion's been now been seconded by Mayor Potem. Miss Gardner, you uh you had a uh comment, I guess? [1:53:25, 1:53:27]: Yes, I still need clarity. [1:53:27, 1:53:30]: Um I need clarity regarding this year. [1:53:31, 1:53:36]: Beyond this year, I understand we may change um. [1:53:39, 1:53:42]: What level of services we want a management company? [1:53:43, 1:53:47]: to operate our amphitheater. I get that, but for this year. [1:53:48, 1:53:53]: Our current contract with the management company is through the end of twenty twenty two. [1:53:54, 1:53:59]: I don't I know their concert series, their last concert is September. [1:53:59, 1:54:03]: But October, November, December, the city is still paying. [1:54:03, 1:54:04]: Management fees. [1:54:05, 1:54:07]: Unless there is um [1:54:08, 1:54:09]: And revision. [1:54:09, 1:54:11]: to the written agreement. [1:54:12, 1:54:12]: Where [1:54:12, 1:54:14]: The current management company. [1:54:15, 1:54:15]: Um [1:54:16, 1:54:17]: I'm still [1:54:17, 1:54:23]: concerned about the exclusive rights. That is why I'm asking. [1:54:23, 1:54:25]: Who's determining? [1:54:25, 1:54:27]: What is considered a concert [1:54:27, 1:54:29]: And what is considered an event. [1:54:30, 1:54:31]: We have a three year [1:54:32, 1:54:33]: Contract. [1:54:33, 1:54:34]: With [1:54:35, 1:54:35]: Pepsi. [1:54:36, 1:54:38]: So if they wanted to do a concert [1:54:39, 1:54:39]: Next year. [1:54:40, 1:54:43]: У детерс вет [1:54:43, 1:54:45]: It will be considered a concert. [1:54:46, 1:54:47]: Or an event. [1:54:48, 1:54:50]: That will be done at the staff level ma'am. [1:54:53, 1:54:53]: Thank you. [1:54:54, 1:54:58]: Yes, ma'am. Question. Go ahead, uh Ms. Gantt. [1:54:58, 1:55:18]: Thank you. I I have some concerns about Mayor and Council being able to utilize the entire amphitheater. I think that it's on another level. It's not necessarily it's not a Mermanders, it's not a community center. We're talking about an amphitheater. Um I think [1:55:18, 1:55:38]: that it would cause problems in the future if we were to do that. We have events uh this council is very active. Um and I know we would look for a date that it's open and uh available, but I you know, including maintenance and upkeep and cleaning and [1:55:38, 1:55:49]: everything else that goes into that. Um, I just think that we should be hands off on it. Um, I I hate that'cause I have some great ideas of initiatives I would love to do there. [1:55:50, 1:55:54]: But I think that it would open up a can of worms. I can see the green room. [1:55:55, 1:55:57]: You know, that's another meeting space Roman and [1:55:58, 1:56:04]: We only have now that we don't have the Ted Strickland, you know, we may need another meeting space room. I could see that. [1:56:04, 1:56:11]: But talking about the use of the entire facility, um, I just don't think it's appropriate. [1:56:12, 1:56:32]: Okay. Uh councilman gap clarity on Mr. Alexander real quick first. I'm sorry. Can I ask him for clarity on his okay. Was your motion just for the green room? No, it was for the entire facility because I wouldn't want to treat us any different than that we would treat the youth council. I mean, you know, we're gonna let the youth council [1:56:32, 1:56:41]: use the entire facility, but we can't use it. So the entire facility. And I believe that's the way Ms. uh the the clerk has it written down as well. [1:56:43, 1:56:44]: Okay, good. [1:56:45, 1:56:50]: Well the youth council. [1:56:51, 1:57:03]: Right, right, so mayor Pro Tem, go ahead, please. Well, uh Mr. Gardner, as you know, when when we spoke earlier, Ms. Gantt, these were concerns that I had about um [1:57:04, 1:57:24]: Any entity of the city, whether it is the youth council, whether it's the DDA, whether it's the D Main Street Board, um, you know, see you that's that same lane. So uh and then the youth council is using uh a third party is coming in. [1:57:24, 1:57:25]: Yeah. [1:57:25, 1:57:34]: Uh utilizing the facility. So these are the concerns that I had, and I spoke these with um with Mr. Garden and and [1:57:35, 1:57:38]: А стігав доз концерн. [1:57:39, 1:57:40]: For me [1:57:41, 1:57:43]: It will be cleaner. [1:57:43, 1:58:03]: See, and and I said this when when the when the youth council came before the board, came before the council. See, I don't have any problem with if the youth council wanted to do a double dutch or a fashion show, any of that, they're under the umbrella. But when you allow a third party to come in, [1:58:03, 1:58:04]: Yeah. [1:58:04, 1:58:11]: that's when you're gonna have a problem. And so and I understand your your point, Mrs. Gantt, but but again [1:58:12, 1:58:15]: When ді when we repurpose [1:58:15, 1:58:16]: The T [1:58:17, 1:58:37]: It was said, and I if I'm not mistaken, we voted that the green room would be that entity that we would use or that the community and the city could use uh to replace the TED. But we don't sort of got away from that. But but see, now we're into this policy. [1:58:37, 1:58:52]: right now and and I raise those concerns. I didn't want to sort of go down this lane uh this evening, but I did raise some of those same concern that you're raising right now and we sort of talked through it. But again [1:58:55, 1:58:58]: I saw to see we opened up a Pandora's box, so I don't know [1:58:59, 1:59:04]: Anyway, go go ahead, Mr. G I know you wanna say something. So Councilmember Thomas as as we [1:59:05, 1:59:18]: um spoke earlier t today, you know, there is provision under here that if you you know, if a council member brings in another entity and that entity is defined under the under the requirements, [1:59:18, 1:59:22]: We charge them just like we charge anybody else. Now how they distribute [1:59:22, 1:59:25]: You know, if they're charging a fee for entry. [1:59:26, 1:59:37]: And they're they distribute that based on a contract between them. So the example we used was if you wanted to host a gospel event in conjunction with the First Baptist Church of Stockbridge. [1:59:37, 1:59:42]: And the fee and all fees collected will go to scholarship for [1:59:43, 1:59:59]: for Stockbridge High School or Stockbridge resident kids and such, right? Um that obviously once we charge that fee, we ch they still will have to pay all the associated fees associated with the with the concert. Um [2:00:00, 2:00:11]: And once you guys, based on the contractual agreement you have with them, the the fees would go to such to those char to to that charitable charitable [2:00:11, 2:00:13]: event or purpose [2:00:13, 2:00:18]: then that's fine. In terms of the youth the youth um [2:00:19, 2:00:27]: council, you know, the issue there's they have they will be signing a contract with the pastor that allow for them to [2:00:28, 2:00:48]: To split the revenues in which obviously he takes 30% or 60% or 40%, whatever that number is. The youth council obviously gets some funding back for their repurpose and reuse. That money would be coming into the general fund and purpose towards the youth council's budget for them to use for the rest of the fiscal year. [2:00:48, 2:00:49]: Um [2:00:50, 2:00:51]: You know. [2:00:51, 2:00:57]: that'll be governed by that that contract, but as it relates to the application and the use of the facility. [2:00:57, 2:01:09]: You know, based on whether it's the non profit event, um, for benefits or a charitable event, you know, we'll charge the associated fees associated with them. That way you're they're governed by the policies throughout. [2:01:09, 2:01:15]: Right and and we and we discussed that, but I if I'm hearing what Mrs. Gann is saying and and I agree with some of that [2:01:15, 2:01:19]: And I heard Councilman Alexander say, Well if the youth council [2:01:19, 2:01:21]: Can use a facility. [2:01:23, 2:01:28]: Even though we are elected and that's a whole different category per se. [2:01:28, 2:01:48]: But just say for an example, if I wanted to put on an event, um, you know, I host the first responders luncheon and I may want to partner say with any other um business owner or any other entity to raise funds for the first responders luncheon. Now I'm an elected uh [2:01:48, 2:01:49]: Uh official. [2:01:49, 2:02:09]: So now is that going to create a problem? And I think I hear what Ms. Gannon said, is that gonna create a problem because I am an elected official, even though the youth council is not? So is there a distinction between the youth council, the DDA board, the Main Street Board, or any one of us? [2:02:09, 2:02:20]: us as an elected official coming in doing something similar. And I think that's where we we may, you know, sort of getting into that problem. So, you know [2:02:21, 2:02:26]: Ms. Gantt, did I try to represent that correctly? Uh yes, uh in so many words. However [2:02:26, 2:02:32]: Uh in addition to that, my my concern was if we just kept it in the green room, fine. [2:02:32, 2:02:33]: But [2:02:33, 2:02:38]: I thought the youth council was doing like some kind of gospel concert, right? They're a group. [2:02:38, 2:02:41]: an organization that's doing a a concert [2:02:42, 2:02:50]: And we'll pay whatever uh fees and it's fund fundraising to go back into a general fund purpose. [2:02:50, 2:03:02]: going back into funding for them. But it but it's a third party. Yeah, well they're paying the third party to perform, I thought. Or I don't know what the third party is, but whatever their split was [2:03:02, 2:03:08]: You know, I wasn't against that more so than having each individual council member [2:03:10, 2:03:10]: I mean [2:03:11, 2:03:12]: Who's this a [2:03:13, 2:03:16]: Back to Councilwoman Al I mean m Councilwoman Barber. [2:03:17, 2:03:17]: You know [2:03:19, 2:03:23]: Are are we gonna uh mayor and council gonna start having concerts? I mean [2:03:24, 2:03:27]: Um what I'm saying is there's a there needs to be a limit. [2:03:28, 2:03:38]: to the use of the amphitheater. It is a brand new building. Um the cost and upkeep, um, maintenance and um [2:03:39, 2:03:45]: Custodial, all that, you name it. I just don't want it to get out of hand. That's my biggest concern. [2:03:45, 2:03:46]: And [2:03:46, 2:03:48]: I think that's foreseeable. [2:03:48, 2:04:08]: Well, if if I could respond to that, this is I I think this is where you're wrong, Ms. Gantt, with the third party with the youth council. They are not paying this third party to come and perform. This third party is the promoter. This third party is benefiting financially. [2:04:08, 2:04:28]: financially from the sales. And in that agreement, they have an agreement to split 6040. So that it's a little different from the U council paying someone to come in and perform. This third party is actually the promoter. [2:04:28, 2:04:42]: And this is where you start creating this problem. And again, if if one of us say, okay, well, I want to rent the amphitheater for whatever, and I go out and connect with a third party, then [2:04:43, 2:04:47]: That's you know, that's why I was sort of reluctant about [2:04:48, 2:05:08]: You know, with the youth council and the third party. And plus, there was no policy in place even at that point in time. And so for us to approve that at our last meeting, I sort of thought it was irresponsible simply because there was no policy in place. And now this is sort of where we are, but I [2:05:08, 2:05:24]: I I but I think the policy that you brought forward, I think it's is a decent policy. It's ought to answer a lot of questions. But I think this is that one sticking point right here about elected officials and and the other organization under the umbrella of the city. [2:05:24, 2:05:28]: I I I would say this the best way to treat that is [2:05:28, 2:05:29]: Yeah. [2:05:30, 2:05:36]: If council partners with a a s a third party promoter to do a concert event, [2:05:37, 2:05:42]: At that point if if the if the goal of it is for a profit [2:05:43, 2:05:48]: on behalf of that other entity and they're not splitting any costs with the city? [2:05:48, 2:05:52]: We treat them under this policy, they pay ten thousand dollars. Right. [2:05:52, 2:05:53]: Mm-hmm. [2:05:53, 2:05:54]: Simple. Correct. [2:05:55, 2:05:58]: I mean if they're coming in, if it's a non profit event. [2:05:59, 2:06:06]: Um and that event is held by the public or civic or educational, religious or charitable organization.
