--- title: June 11 2018 City Council Meeting date: 2018-06-11 source: 2018-06-11_June_11_2018_City_Council_Meeting.wav --- [0:00:11, 0:00:31]: Alright, ladies and gentlemen called the meeting order. I have 603 on my actual phone. It's a little fast over there. And uh what I'd like to do is uh call Reverend Jackie Johnson up to give the invocation. We just actually earlier honored her proclamation on her retirement, and I'd like for her to give, since her day, I want her to give the invocation. [0:00:31, 0:00:35]: for us tonight. Please, Ms. Johnson. [0:00:41, 0:00:42]: Let us pray. [0:00:43, 0:00:45]: Eternal God our Father. [0:00:45, 0:00:54]: We acknowledge your holy presence in our lives at this moment. And God, we thank you for the opportunity of service in this community. [0:00:54, 0:01:02]: And in every aspect of our lives. We ask, O God, that you govern by the power of your Holy Spirit, the business conducted here today. [0:01:02, 0:01:08]: And may you be pleased, O God, with our actions. Be pleased, O God, with everything that we say. [0:01:09, 0:01:14]: And may what we do, O God, honor you. It is in Christ's name we pray. Amen. Amen. [0:01:15, 0:01:21]: Please remind us. [0:01:40, 0:01:42]: Councilman Blount. [0:01:42, 0:01:52]: Present. Councilman Thomas. Present. Mayor Ford. Present. Mayor Pro Tem Gantt. Present. Councilman Alexander. Present. Councilwoman Robinson. Present. [0:01:53, 0:02:05]: Mayor Ford, do you have a form? Thank you. Appreciate it, Clark. Council, I need a motion to adopt proceedings agenda, please. So moved. Second. There we go. Any discussion? All in favor, please indicate. [0:02:06, 0:02:07]: Thank you very much. [0:02:08, 0:02:28]: Council, what we have before us approved minutes for the following meetings. April 10th, 2018, April 11th, 2018, April 24th, 2018, and May 14th, 2018. I would assume that you've reviewed those particular minutes. And if that is the case, I need a motion to have them approved. [0:02:28, 0:02:41]: Is there a second? Second. There we go. Any further discussion? All paper is indicated. Okay, thank you very much. Madam Clerk, do we have any public office remote? [0:02:41, 0:02:44]: We do mayor, Mr. Derek Favours. [0:02:44, 0:02:49]: Give us a favors, please come forward sir and name and address. [0:02:51, 0:02:55]: Yeah, specify here. Is it volume? Okay. [0:02:57, 0:03:17]: Um Derek Favors, uh 587, Serene Waters, uh Trail of Jonesboro, Georgia. Uh I live in the city. Um I just want to tell you all thank you for uh the opportunity to come up here and speak. Uh just wanted to kind of bring up an issue that's been an ongoing um incident that's that happened in our association. I'm current. [0:03:17, 0:03:37]: uh HOA president for the Fallen Lords Community Association. Uh we've had a home that's been running a boarding house that's been cited as boarding house. It's also been indicated in uh issues with uh parking ordinance within our area. Uh so we've had um just transients and different people in the area that don't stay there. [0:03:37, 0:03:57]: Sleep in the cars that wanted the neighborhoods late at night at two or three o'clock in the morning. This issue has been ongoing for about two to three years. We brought this up to the code enforcement several times prior to my to my tenure as president, which I've only been serving since uh September. So we want to just be on record to bring this up again. [0:03:57, 0:04:17]: And to let the city know, you know, that we are having this issue and it's been a constant issue and it's worsened over the years. So um, you know, for my uh association people, my neighbors, you know, I want to make sure first that we protect them, we protect their safety, their well-being. We also want to make sure we protect our uh property value within our area. So um that's [0:04:17, 0:04:37]: That's pretty much all I had to bring up to the council's attention. I appreciate that. Thank you. Uh am I assuming this is a legal accident already about this? Yeah, there there is some legalities going on too. From my understanding, it was something that happened today uh with that per with that particular person within our association. So but we keep bringing this up and it's kind of fell on death ears on and off over the years. [0:04:37, 0:04:57]: Um so we're trying to lean definitely on the parking ordinance uh that the city does employ because we do have no parking uh signals on that particular street and we do want to tow. Uh so that's one thing we want to have a leg stand on when we uh when we actually uh address this issue with that resident in the neighborhood. Well noted uh but of my understanding the the speaker matters for all of this is [0:04:57, 0:05:00]: not much we can do right now since it's in the court system. [0:05:00, 0:05:20]: Uh yeah, I I don't know all the particulars on it. Uh I know there has been uh judgment uh left against this person at one point or another, uh, but that person still hasn't adhered to the uh arrangement that was made between them and the city. So it's still ongoing and from my understanding there was some type of uh court hearing that went on today with that particular person and they still haven't adhered to it. [0:05:20, 0:05:30]: Okay, thank you. Appreciate it. Okay, all right. What unless you have something to say or illegally. You have something to say about this? Okay. [0:05:30, 0:05:31]: Thanks for you. [0:05:33, 0:05:35]: Miss Molly Hammer. [0:05:37, 0:05:57]: I was just going to reiterate reiterate the fact that there was court action taken uh late last year uh regarding the matter uh there and also uh today there was some additional court action taken. Um and uh hopefully of course uh it's our hope that this will address the [0:05:57, 0:06:08]: issue and hopefully there will be relief for it and then we obviously will continue to monitor the situation. Okay, thank you sir. Yes ma'am Ms. Molly Hammer. Molly Hammer. Okay. [0:06:09, 0:06:13]: Please come to my handler, the name and and uh address please. [0:06:17, 0:06:37]: Molly Hammer. I live at five um 525 Streamwater Strail, and um I would like to speak um about what Derek just spoke about. Um so the person who bought the house, Boyd's, they bought the house in 2010, and it was in 2013 that I started noticing um different. [0:06:37, 0:06:57]: people moving in and out of the house, living down in the basement was after that hail storm. So the first group of people were actually roofers that were from Texas that were renting rooms from her. And then after that, after the roofing business, you know, all the roofs were fixed, then another group of people came. [0:06:57, 0:07:15]: various groups of people um of all nationalities um uh from my what what she's told me is that she was um renting off of Craigslist and I actually found evidence um last year of um her um [0:07:17, 0:07:37]: of her renting rooms for five hundred dollars apiece on Craigslist and printed it off and sent it over to um Officer Johnson. Um I was actually also subpoenaed um in O November, November second to testify against her um when um she went to court. [0:07:37, 0:07:57]: After court, things got a little bit better. Stopped seeing all the cars parked on the street. There was a flurry of people moving out. Things were better for a while, but they have gotten excessively worse. There a few months ago, walking my dog, there's six cars parked in the street. [0:07:57, 0:08:17]: Four cars in the driveway. People living there. Um just last weekend walking my dog early in the morning, two people sleeping in a car that I took pictures of. Um so yeah, I'm I'm worried for my family and you know I shouldn't have to be worried for my family. We don't know who's coming and who's going. [0:08:17, 0:08:25]: Um two years ago when I was the president of the board, that's when I started contacting um [0:08:26, 0:08:39]: people, Officer Johnson, Code Enforcement. Um I think Mr. Harris was the um city manager back then. Um so we started this process at um [0:08:40, 0:09:00]: back um January twenty seventeen of actually trying to, you know, do something official. Um as president of the board, you know, we've the board spoke to her about parking and um she's just blatantly um disobeying the laws, the covenants. [0:09:00, 0:09:02]: and it's time that it stops. [0:09:04, 0:09:24]: Okay. Thank thank you for comments. We've already made note of the situation. The world's court action going on. I'm pretty sure the police are involved in this as well, this aspect. Okay? Thank you very much. Any other comments? There are no part of the comments. On that note we'll go into a ceremonial portion of the meeting, but uh want to acknowledge the fact that uh the invocation once again was done by Reverend Captain Johnson. We had [0:09:24, 0:09:44]: A proclamation of ceremony murder 40 and uh listen wishing her well on on her uh actual retirement. And uh we also uh had a proclamation uh as a council initiative going to agree with American Heritage Month. Chris Scott and Jackie uh uh Watson were here. I don't know if we're still in the audience, no they're not, it'll seem like and then uh [0:09:44, 0:09:57]: I do have uh another elected official, a fellow uh council member uh from Hampton, um Mr. Earl, uh Mitchell Earl of Hampton. There you go. So we got our council member. [0:09:58, 0:10:01]: [611.5, 631.5]: Okay, so we have a couple proclamations uh to read. And the first one up is dealing with um I don't know, is this this actually working here? I mean it's low, but it's on. It's on, yes it is. Deals with the Alzheimer's, and that's one of the reasons why I'm wearing purple. So uh anybody here uh the Alzheimer's please [0:10:31, 0:10:32]: Please come forward. [0:10:42, 0:10:50]: I'll I'll read the proclamation and then I'm going to give you the proclamation and give you the mic to have any comments that you may have. Come on down. [0:10:50, 0:10:50]: Yeah. [0:10:51, 0:10:52]: Okay. [0:10:52, 0:11:12]: I have to oh I forgot what's your name, I'm sorry? Elizabeth Bradley. Miss Bradley? Debbie Watkins. Debbie Watkins. Kevin Bradley. My assumed husband and wife? That's Bradley. Okay, all right, good deal. This is a proclamation in reference to Alzheimer's. Whereas Alzheimer's disease is a progressive brain disease that slowly deteriorates the brain cells affecting one's reasoning skills and building [0:11:12, 0:11:32]: Perform simple tasks, ultimately leading to memory loss. Whereas Alzheimer's disease, which currently has no cure, is the sixth leading cause of death in adults aged 18 or older in the United States. Whereas with no currently defined definitive interventions to prevent Alzheimer's disease, essential public health services [0:11:32, 0:11:52]: Of early detention, detection, excuse me, risk reduction and surveillance are necessary to protect and improve the health of our citizens. Whereas during the month of June, citizens across Georgia take part in the longest day to raise awareness and support research and care for Alzheimer's patients. Whereas further research of Alzheimer's disease is critical. [0:11:52, 0:12:12]: As it is the only cause of death among the top ten causes in the United States that currently cannot be prevented, cured, or even slowed. Whereas nearly 50% of individuals with increased memory problems reported they had not discussed their symptoms with the health care provider yet, early and documented diagnosis when [0:12:12, 0:12:32]: coupled with access to care planning and services leads to better outcomes for individuals with Alzheimer's disease as well as their caregivers. Whereas caregivers and family members are crucial in maintaining a healthy quality of life for those battling Alzheimer's disease. And now therefore I, Anthony S. Ford, by virtue of authority lesson to me, as mayor of the city of Stockbridge. [0:12:32, 0:12:52]: Georgia and on behalf of City Council members Elton Alexander, John Blount, Lakeesha Jack, Meet Robinson, and Afonso Thomas to hereby recognize June 2018 as Alzheimer's and Brain Awareness Month in the Stockbridge, Georgia. And we call this observation to the attention of all citizens. And witness thereof, I have hereunto set my hand. [0:12:52, 0:13:03]: hand and the great seal of uh city of Stockbridge, Georgia, on the 11th day of June in the year of our Lord 2018. And I signed this along with our city clerk Vanessa Holliday. Thank you so [0:13:11, 0:13:31]: I don't know what to say. Anything you like. Um thank you guys so much for the recognition. We really appreciate it. Um this is the first year that our walk will be an official walk. Um we will no longer be a team out of Atlanta. So um we're very excited about that. The walk will take place September twenty ninth at Alexander Park. [0:13:30, 0:13:43]: um off of Jonesboro Road. And registration begins at 8 and you can register by going to Georgiawalk.org and finding Henry County and clicking on it from there. [0:13:43, 0:13:53]: Thank you, appreciate it. Um we're gonna take a picture with the entire council right back here if you don't mind. Okay, thank you. Thank you. You can go you can go this way? [0:13:53, 0:14:00]: Oh we think that's in a little bit. [0:14:20, 0:14:21]: Yeah. Okay. [0:14:23, 0:14:32]: Can slip gentlemen, you just slip in there. Ladies, just come on down. Can we get everybody? I don't mind. [0:14:37, 0:14:40]: [909.4, 910.0]: Thank you. [0:15:12, 0:15:32]: Now I have to admit, proclamations are always cool to really speak about and give and honor those special folks of the organizations. But this one tonight, in reference to uh another Stockbridge citizen, has done so well in the music industry, and I'm just and I didn't get a chance to meet Mr. Childers earlier this evening because I was up here, so I'll get a chance to meet him now. [0:15:32, 0:15:34]: Mr. Ross Childers, please, could you come forward? There he is. [0:15:46, 0:16:06]: Now I will tell you, you have your family here. I'm gonna read this and I'm gonna eventually give you the mic, okay? But if you want your family up here with you as well, have that? Come on. There's a lot, so we'll just do it? Okay. All of this we're good. Whereas Ross Childress hails from Stockbridge, Georgia, and is co-founder member of the band Collective Soul. And whereas Ross Childress [0:16:06, 0:16:15]: attended Stockbridge High School and was influenced by the Beatles, Prince, and The Cure, and whereas Ross Childress was inducted in the Georgia Music Hall of Fame in 2009. [0:16:15, 0:16:31]: Whereas Ross Childress is the platinum rocker played lead guitar and some of the biggest songs of his era. The group's le uh hook laden guitar anthems and powerfully me melodic songs led to them to have seven number one radio hits. Seven number one radio hits. Okay. [0:16:36, 0:16:39]: The nineteen top forty singles. [0:16:39, 0:16:40]: Yeah. [0:16:44, 0:17:04]: Whereas Ross Trildes was a lead guitarist for Collective Soul and his indebted guitar uh guitar work uh was heard by millions of fans from around the globe. From nineteen ninety-four to two thousand one, Collective Soul received more airtime than on the radio than any other band in its era, including Nirvana, Pearl Jam, Soundgarten, R. [0:17:04, 0:17:06]: RNA and Oasis. That's outstanding. [0:17:13, 0:17:33]: Ross currently currently resides in Henry County and enjoys working with children groups such as the Children's Health Care of Atlanta and is currently writing music and movie scores and commercials and loves doing it. Now, therefore, I, Anthony S. Ford, by virtue of authority vested in me as mayor of the city of Stockbridge, Georgia, and on behalf of City Council members Elton Alexander, John Blount, Lakeisha Gantt, Need Robin. [0:17:33, 0:17:45]: And Father Thomas do hereby recognize Ross Childress, co-founding member of Collective Soul from Stockbridge, Georgia, and invites everyone to come out to his performance of the Sound of the Summer concert Saturday, June 16th. [0:17:50, 0:18:10]: Oh yes, absolutely. Okay, I'll stand it. And whereas thereof, uh I here I'm to set my hand in the great seal of the city of Stockbridge, Georgia on the eleventh day of June of the year of our Lord two thousand and eighteen, and I signed this uh proclamation along with City Clerk Vinnes Hall. All right. [0:18:17, 0:18:37]: See the Stock Ridge thing you guys are awesome. This is really cool. So yeah, I'm looking forward to um Saturday. The sounds of summer kicking it off and uh it'll be a a good time. But yeah, honestly though, I remember when the first red light came in, which was like right over here. The first red light stock bridge and then the bridge when the bridge happened. Stockbridge never was the same as the bridge. [0:18:37, 0:18:37]: Ha ha ha. [0:18:40, 0:18:41]: Well it's around scared. [0:19:01, 0:19:05]: [1155.0, 1155.9]: Yeah. [0:19:22, 0:19:23]: Over here. [0:19:23, 0:19:24]: Mm. Oh. [0:19:25, 0:19:26]: Don't you know? [0:19:28, 0:19:31]: Sorry. [0:19:34, 0:19:37]: Yeah. [0:19:55, 0:20:05]: All right, uh we'll move on to business. [0:20:06, 0:20:13]: Council considerations to postpone the rest of the airborne agreement until further notice. Mr. Mike Williams, sir, please. [0:20:14, 0:20:20]: Good evening. Now I can say that I had a major rock star open for me to start [0:20:25, 0:20:45]: Merit Council, you have before you a resolution um that's really housekeeping. You all have already discussed this before, but this kind of evidence it evidences it in writing. Um this is uh calling on the postponement of further consideration of the Western Parallel Glaimon until we have more. [0:20:45, 0:21:05]: information come before us regarding its location and uh so from that perspective we would ask that it be approved by the very council okay um this core please we would then postpone um whole business item number seven for council consideration of the listing limit approved [0:21:04, 0:21:20]: Sorry. Uh Mr. Mayor, just to be clear, I uh approval of the resolution is what we're asking the motion to be because the the resolution itself postpones a consideration. [0:21:20, 0:21:40]: Mayor, I I'd like to restate my motion. I would like to approve the resolution postponing the West Carol agreement. All right. So there are second okay now discuss it please. Council discuss it. So one point of clarification. This was just a lighting. [0:21:40, 0:22:00]: We need to change the motion for that. Alright, there's no further discussion. All in favor of the motion, please indicate? All opposed? You sustain? Okay, so we got uh one sustain. Okay. [0:21:59, 0:22:19]: Council consideration to approve the vehicle use policy. Mr. Wins, please. Um this is the uh draft policy that had been discussed uh a number of times, but yet the final or perhaps the final version uh in front of you. Um it just sets forth a number of conditions uh under which city cables are to be used. [0:22:19, 0:22:39]: I'm going to summarize some of the major points. First, we have had in place a take-home vehicle policy, and so this replaces that with sort of a streamlined policy. [0:22:39, 0:22:59]: And it also provides for replication of of take home vehicles if necessary. Um it goes on to provide that city vehicles are to be uh used um primarily for city business. Um it lays out prohibited uses and these are some of the obvious things, obviously alcohol. [0:22:59, 0:23:19]: The use of tobacco is prohibited in vehicles, no transportation of pitchhikers, et cetera. And then with respect to passengers, it it goes back to the uh and and encompasses the waiver provisions that you all previously adopted and provides that it [0:23:19, 0:23:39]: non employees are e are transported they have to sign the waiver. Um and uh then it provides that if if any city vehicle um is operated and the driver receives a citation that the driver is responsible for paying that citation in the city [0:23:39, 0:23:59]: And then it has a procedure for disqualifying drivers for whatever reason. And these are to protect the city and just to make sure that they're only allowing responsible drivers to use city vehicles. And then it it has a [0:23:59, 0:24:19]: A set of procedures for if vehicles are involved in an accident. So those are the major things. And then what this does is it kind of brings into one policy all the uh the procedures that we had in place. We had them in three different places before, and this kind of puts them all. [0:24:19, 0:24:39]: to one policy. And so uh unless you have questions or want to make some adjustments, I would recommend this for approval. Um city attorney, um I guess I just want to be all right [0:24:39, 0:24:59]: Record for my concerns. I mean, I know you did this policy, but at the same time you're still holding on to this waiver. Um, so that this waiver is still intended that you can have someone in the vehicle spouse as long as they're signing a waiver. Um, I just want the citizens to know that I'm still [0:24:59, 0:25:19]: Against that, um, you're in a government vehicle, and if you're gonna be in a government vehicle, then you should not have a spouse or anyone in the city vehicle. You should not. And I'm strictly against that, but again you have stated that the waiver still stands, and that was the back and forth from [0:25:19, 0:25:39]: The previous because when we go out of town, we're going to be using different vehicles. Because that way, if you design a waiver for your spouse, that could be three or four vehicles or four or five vehicles traveling down the road when you can limit that to two vehicles. Because council members can ride together or if they want to. [0:25:39, 0:25:59]: Protect their spouse, they should drive their own personal vehicles. But again, um, there was an incident, and now we're bringing it to the forefront to let it be to where we were making it okay. Um, so again, I just want to go on record that I'm against any elected official or anybody employed with the city. [0:25:59, 0:26:18]: having their spouses even with a waiver in a city that should not take place at all. So I just want that for the record. Yes correct is yeah I'm moving to approve the uh vehicle users policy presented by Mike Wickers. Is there a second? A second. Okay, is there further discussion? [0:26:20, 0:26:40]: No further discussion? Okay. All in favor of the resolution, please indicate. All opposed? Okay, sweet two. Pass. Now this is the resolution not ordinance. Yes, sir. Okay. Alright, so did it. It passes. The uh sorry. No, that's uh that just one clarification. Council [0:26:40, 0:26:45]: consideration is Kansas City's Trump moratorium. Moratorium is headed by Mr. Williams. [0:26:45, 0:27:05]: A number of months ago, you all adopted a moratorium on the establishment of any new truck-related businesses in the city. That moratorium is set to expire in a few weeks, if I recall correctly. And we're asking you to extend it further establishment. [0:27:05, 0:27:25]: is is going to be presenting an actual revision to the ordinance that makes it clear um where any kind of truck related businesses are permitted in the city. And no we adopted the highway overlay and have some provisions there, but we want to clarify certain sections of the ordinance. So we'd like for you to extend them more toward [0:27:24, 0:27:44]: We can bring that back. All right, Council. Yes, ma'am. Mayor Ford, I move that we um approve the extension of the city's truck moratorium. Okay, is there a second? Is there a second? A second. There we go. Second there? Any further discussion? Yes. Go right ahead, please. I I share a lot of the citizens' concern. [0:27:44, 0:28:04]: About trucking related facilities in the community. And I actually was one of the sponsor of the highway overlay bill to be passed here in the city of Stockbridge. The city currently has a prohibition on all major highways in the city related. [0:28:04, 0:28:24]: Related to trucking related facilities and trucking related businesses on all major highways. As someone who, with all transparency, was in the trucking business myself for numerous years. These trucks need somewhere to park. And we as a council we don't want [0:28:24, 0:28:44]: them parking on our main street. We don't want them to park in terms of in residential areas. Because right now that's what they're doing. They're parking in residential areas and subdivisions. You go to Walmart, they have parking there, you go to Kroger, they're parking there. These trucks are already in our community parking everywhere. [0:28:44, 0:29:04]: What we need to do is we need to come up with a plan where it is acceptable to us to allow them legal parking within the city or they will continue to park illegally. Numerous times I've come down Rock Corridor Road where a tractor was pulled over to the side and notified the police that they were pulled over. [0:29:04, 0:29:24]: To decide waiting on somebody just to run them under that truck. We just need to make sure that whatever we do, there is a path, legal path to legal parking uh for these trucks to operate. They are the commerce uh in our community, and we want to make sure that whatever we do uh [0:29:24, 0:29:44]: is fully uh legal and embraced by safety experts, not necessarily hysteria concerning the trucks. And you know, sometimes I find out that these issues, the trucks are being used as scapegoats for the fact that we have two-lane highways and the highways aren't being maintained. It is not all the trucks. It is the [0:29:44, 0:30:04]: Failure of leadership in this county and in the city and a lot of these instances to maintain and to properly plan for infrastructure in these particular areas. I would like to ask a question of staff. When is this going to be presented? We have had uh well, this is this has been working. [0:30:04, 0:30:14]: worked on for quite some time now, including uh when we uh were going to actually enforce the residential parking uh in subdivision. [0:30:15, 0:30:35]: Mayor, member of the council, as you know, we're doing our comprehensive plan and a number of issues have come before us concerning transportation. And so we're putting this on hold until we look at the rating of our roads and our highways as we go through with our land use to determine where these type of users should be located as it relates to the transportation network. [0:30:34, 0:30:54]: To make sure that how these trucks roll out and get to the expressway, that there's a close proximity to keep them off of the two lane roads. And that is a part of our comprehensive plan, as you know. So just wanted to and that's due to DCA in August. In August to DCA. And then we will expect implementation to be what what [0:30:54, 0:31:10]: Well DCA is not going to approve it till the end of the year because it may come back with comments. Uh they will make some decision around November, December, and then by uh January of 2019 we should have a sign-off by DCA to implement that plan. [0:31:11, 0:31:21]: Okay, any further questions? Council? Okay. That's uh further questions, we have a motion of four. All in favor of the motion, please indicate? [0:31:22, 0:31:30]: All polls. Sustain your polls. Okay, full one. Oh okay. All right. [0:31:32, 0:31:49]: New business, council consideration to amend Title IX, Section 9.12 of Stop Raising Missal Code by hereby deleting and replacing Section 9.12 in its entirety as it pertains to solicitation, permit, and process. Mr. Williams, please. [0:31:50, 0:32:10]: Mr. Mayor and Council, again this is probably more housekeeping than otherwise. Um our current ordinance provides that those um applications go to the city clerk and this changes it so that they go to the administrative and community services department for processing. That's essentially all this does. [0:32:10, 0:32:21]: Okay. Alright. Yes sir. Yes sir. I'll move the way be um taken into consideration. Is there a second? Is there a second? [0:32:22, 0:32:24]: I I'm sorry to take it. [0:32:25, 0:32:45]: No, he didn't say different. He didn't just sit down. This my Mr. Question will do that. My motion is you you you want the vote to be moved. Yeah, I want to approve it. We're just moving it over. Uh council, I I move that we approve this item nine section nine point one two of this code. Okay. You said that okay. [0:32:44, 0:33:04]: Any further discussion? Yes. Go right ahead, please. Now, while we have this issue before us, uh, we have an issue with panhandling in the city, we have an issue with uh you know aggressive panhandling and folks who are basically conning people. Uh we have uh people using children out there at different uh shopping. [0:33:04, 0:33:24]: Centers and areas. Why can't we deal with that in some form or fashion as we're discussing this? Because this is an ever-present thing that we see in the community and citizens are really concerned about. I can't go over the Hudson Bridge without somebody standing in the right-of-way. [0:33:24, 0:33:44]: collective change and then you see them drive off in a nice new car and they're standing there collecting change and citizens are kind of kind of kind of fed up with that and uh you know at this point I'm not really sure whether uh those are whether co-enforcement is enforcing that or the police are enforcing it at this time [0:33:44, 0:34:04]: Time because as uh we've had this issue come before us numerous times, and we want to put the best representation of our city out there, and we need some something done. It's a law enforcement issue, it's not a code enforcement issue. Okay. So what are we able to do uh to with Henry County police? [0:34:04, 0:34:24]: at this time. Are they have we have talked to them? Are they even enforcing it at this point with what we are or is it even being enforced at all? Or what do we need? Do we need to get code enforcement involved because of the situation with the local ordinances or are they enforcing it? It code enforcement by state statute and your [0:34:24, 0:34:44]: By law can only do certain things because they're not law enforcement. It is a law enforcement issue. So it would have to be some arrangement between the city of Stockbridge and every county police. [0:34:44, 0:35:04]: What can we do legally uh to work something out where we have somebody in the city or some agency? Well, I don't know if we need to hire outside agency or what to be able to uh deal with this uh uh in in particular. Is there is there anything we can do in the city? Let me let me sign it here. Uh do the [0:35:04, 0:35:24]: SBS type of agreement. Is this something that Mr. Bag is going to work with with the county or as we work with the police department or anything like that? Something we can do? I don't think I I don't think it's a it's a liberty issue. Okay. It's a matter of perhaps having some conversations with the police department about concerns that have been expressed and raised. I'll be glad glad to do that with Captain War. [0:35:24, 0:35:44]: I think what this ordinance is trying to do is trying to address some of these issues and bring some regulatory aspects to some of the things that take place that would take place legally, hopefully that will drive people from engaging in illegal activities. And I think that's what this is intended to do. Okay, great. Any other comments from the council? Yes. [0:35:44, 0:36:04]: You know, uh we all can sit back and shake our heads at this issue, but we do have a problem. Not only in this in Henry County, but we have a problem around this country when it comes to homeless people. Um I've dealt with a lot of homeless people around here. They don't jump in the fancy car, they jump back in the woods and go to sleep. And so when we sit back, [0:36:04, 0:36:24]: And we have organizations that we sit here, we even give proclamations to. We can go talk to I don't wait on other people to solve my problems in my community. I go to the source. I go to these homeless people. I tell them about the resources that they can deal with. I fed the homeless in this community. We can't sit back and continue to see a see a situation and wait. [0:36:24, 0:36:44]: We don't somebody else to resolve it, but we can start resolving ourselves. Can you have comments from the council? Yes. Correct, please. Um so Mr. Knight, the city manager, you said you will be able to have a conversation with our police captain, correct? Absolutely, yes. So having steps to communicate, that's the main key. Sure. [0:36:44, 0:36:52]: Thank you. Any other comments from the council? If not, there's a motion on the floor. All in favor of the motion, please indicate. [0:36:54, 0:36:56]: All polls? [0:36:57, 0:37:15]: Okay, excuse me. I miscounted. All right, good deal. Thank you. Thank you. Ambassador Nelson. Council consideration to amend chapter 9.101 of the stockbridge municipal code by hereby amending and adding a new section. [0:37:15, 0:37:35]: Nine point zero one point two six zero to provide for single veterans engaging operating businesses and practicing professions in small police. Yes, uh mayor and council, what staff brings before you tonight is an ordinance that just brings stock rice in compliance with the state law so that when people come in to stock race who are veterans that want [0:37:35, 0:37:55]: An exemption on the business license. They know that it's consistent if they go to Hampton, if they go to Jonesburg, wherever they go, that the state laws are in this and that they understand that the rules apply across the board. So that's all that this always does. Okay. Any questions at all from this floor? [0:37:54, 0:38:12]: So okay, is there a second? I second. Here we go. Any further discussion? All things please indicate? Okay, it's unanimous. Appreciate it, thank you. Council consideration to approve selection of the C's Health and Wellness Insurance Policy. Staff recommendation, Sigma health care. Ms. Wheeler, please. [0:38:25, 0:38:38]: Mayor Council, how are y'all tonight? Just fine, but still. Doing well, thank you. I believe in your packets you have the executive summary. Yes. Maybe you all had time to read that. So what I'm gonna do is just do a PowerPoint. [0:38:38, 0:38:40]: Summary of my summary. So [0:38:41, 0:39:01]: And and I think Ellen, this is only going to take about forty, forty-five minutes, so we got plenty of time. Um sorry. This is our time of year which we go up for renewal for our medical or health benefits. Uh Mr. Wendell Strickland is our insurance program, so he's the one that goes out and and uh assesses the market. [0:39:01, 0:39:21]: To try to give us the best possible price and plan for our insurance premiums. He's going to give you a short presentation on what we've what he's gone through to get us to this point and hopefully your approval on the health planation. And thank you so much. You have great staff. We've been working together for many years now. [0:39:21, 0:39:41]: We work really hard to kind of uh look at the options this year. Um so um like I said in your uh packets you have the executive summary. Um so strong size solutions is a healthcare consultant. We specialize in cities and counties in helping you all maintain good benefits, make sure that you uh do the fiduciary responsibilities and bid things out, and that you provide uh good. [0:39:41, 0:40:01]: quality health care as low as possible possible to your employees. We went and marketed this year and everything we were doing is going to take effect July 1, 2018. That's when your renewal is. And our markets this year we went out to um all the appropriate you have fully insured carriers, you have level funded carriers, you have captive self-funded [0:40:01, 0:40:12]: stop loss markets and third party administration. So we went out to a myriad this year to make sure that we check not only your fully insured marketplace, but all the other types of alternate funding and insurance products. [0:40:13, 0:40:33]: Uh this year uh the City of Stockers had 137% utilization. That means for every dollar that you gave Cygna, they paid out a dollar thirty-seven. So you have what we call a high claims year. So um your premiums of$775,000, I think Cigna actually paid out like a million sixty-two. So uh you're running what we call hot, so uh being able to look at other carriers to take that risk at a low. [0:40:33, 0:40:53]: Lower rate didn't result in any competitive carrier. So we have a couple of ongoing large claimants over$25,000 and several prescription drug claims to kind of make that go higher throughout the year. So the original renewal was 30.4%, which was an increase of$232,000. We were able to get that down to$13.1%. [0:40:53, 0:40:56]: one uh or a hundred and one thousand dollars an increase. [0:40:58, 0:41:18]: Um the carriers that we went out to um neither the fully insured carriers, the level funding carriers, the um uh captive markets and the self-funded carriers provided a lower lower cost alternative. As a matter of fact, most of them came in in the 40 to 50 percent increase. So um I think taking the uh 30 percent increase from [0:41:18, 0:41:38]: Signa and bringing it down to 13.1 was a real uh achievement this year, considering the ongoing claims and the liability that the city has as far as claims, liability, and risk. So if you look at this page here, this is your um your benefit plan dynamic. We were able to get the 13.1% increase with keeping your exact same plan. [0:41:37, 0:41:57]: We thought that was really important for employees this year since there's a lot of change going on is to not have either increased deductibles or increased costs or increased co-pays. So we're able to do that by maintaining those current um uh plans. And then uh this is this is the resulting uh uh uh premiums or tier increases uh [0:41:57, 0:42:00]: uh from last year compared to to this year. [0:42:02, 0:42:22]: We also have a lower deductible to your employees, and the city takes on the second portion of their deductible. That way that the deductibles to your employees is kept lower, right? So it's called a split deductible or a health reimbursement arrangement. So we have that this past three years and it looks something like this. So you actually have a$2,500 deductible. [0:42:22, 0:42:42]: For an employee, but your employees only pay$500 of that, and the city pays a second$2,000. So even though there's a higher deductible in the plan, the employees' responsibility is really low. And compared to other cities and counties in the area, only having$500 as a deductible annually for a medical insurance plan is very, very rich. So it should be really good for you in the city to [0:42:42, 0:42:45]: to be able to track and retain good employees. [0:42:46, 0:43:06]: So if you look at a summary, medical is 13.1, dental, we got it down to two, uh, vision zero, basic life zero, voluntary um life zero, short-term disability zero, and long-term disability zero. And we've been able to get this zero increase on uh vision, uh basic life, voluntary life now for almost five years. So I think that's a great track. [0:43:06, 0:43:07]: Recording. [0:43:08, 0:43:28]: So all that wrapped up in a recommendation that would be for the 2018-19 plan year would be to renew with Cigna, to maintain your current health reimbursement arrangement or your split deductible, maintain your prescription drug programs, renew with human for dental, renew with IMED provision, renew with mutual Omaha for basic light volunteer life. [0:43:28, 0:43:35]: life and short-term disability, maintain your wellness program and keep the payroll deductions the same as what we the staff and I had had talked about. [0:43:37, 0:43:57]: Okay, thank you. Uh any questions for Mr. Spritler? Sir. I will just say as one of the people who have used the service and are currently using it, you have done well. Well thank you. [0:43:57, 0:44:17]: No additional funding at this point and uh been able to maintain um a level playing field from last year with all the increases in health care costs. This is outstanding and this is just want to make sure that I'm summarizing what you just told us pretty much is that our employees uh this year would not be facing any additional [0:44:17, 0:44:30]: cost and then we'll be looking at same the same baseline numbers as they were looking at last. That's right, same exact medical plan, no increased cost and premiums, and the same deductibles, co-pays, and co-insurance, correct? [0:44:30, 0:44:39]: Uh I make a motion to move forward with this because I don't think we can do any better than that. That's outstanding. Sir Second. Thank you. All right, great. Any further discussion? [0:44:40, 0:45:00]: All right, all three remote please indicate? Yes, but on the record and and I just want to make clear, yes, there will be no impact to um employees. It would be the same covers that's been in place before. There will be a slight increase, though overall budgetarily, uh to the city. I just want to make that clarification. [0:44:59, 0:45:08]: Okay. And our recommendation is is that this should be. Okay. Let me let me ask you let me ask for motion on the four to say. All favorite motion please indicate? [0:45:09, 0:45:12]: Thank you. Okay. Thank you, sir. Appreciate it. Thank you very much. You're welcome. [0:45:15, 0:45:29]: Council consideration to approve, amend the city established personal policy to reflect Georgia State Law House Bill 673, hands-free cell phone policy, effective 1 July 2018. Ms. Wheeler, please. [0:45:48, 0:46:08]: Good evening, Mayor and Council. Evening. We have a new policy that we're putting uh we've put together due to the new state law that is going to affect House Bill 673, which was passed by the House and Senate and goes into effect July 1st of 2018. [0:46:08, 0:46:26]: regarding the hands-free cell phone policy. So we have drafted a policy for you to approve that will go into effect July 1st and all employees in reference to what will be required as far as the hands-free cell phone policy. [0:46:28, 0:46:41]: We have the slide for that for this. I don't have a slide, it should be in your handbook. Okay. I'm just saying for your email says it's not so good. I don't have a is there a motion to accept this? [0:46:42, 0:46:45]: Questions. Have you had a chance to read it? [0:46:50, 0:46:55]: Well, right. I don't know why we would have the policy, but since we have it, I make a motion to [0:46:55, 0:47:15]: Who said the number? Who did the second second okay? Any any further discussion? Yes. Go right ask. I I obviously we definitely want to follow the law. I just have a question for staff to make sure that we're doing everything that we can do to be totally in compliance. So we have a older vehicle out there. [0:47:15, 0:47:35]: That's not equipped with hands-free service. Are we equipping these vehicles? Are we making are we retroing them? What are we doing to make sure that that old public works truck or whatever they gotta follow in there with them? What are we doing with that? Well, most of the public works trucks have been replaced to newer vehicles. The Navarre. [0:47:35, 0:47:55]: been outfitted for the uh for this. The only two trucks that I know of that we are uh going to work with are these code enforcement um trucks and getting them a a device where they can put their work cell phones in and make it hands-free. [0:47:55, 0:48:02]: Okay, so at this point we're saying that pretty much that's the majority of the vehicles are already. Right. [0:48:04, 0:48:24]: And for the questions under the council. Yeah, that's it. Go right ahead. This didn't outlaw Bluetooth and earpieces. This is this I mean if you still put on the earpiece, that's hand free. I mean it didn't have to necessarily come out to be a just didn't want people holding holding. Right, holding the phone up and and and [0:48:24, 0:48:44]: uh and driving but we've had some instances where employees are driving in their vehicles and they have their phone up to the air up to their ear. I mean I've seen it and stuff so since it's actually the law now for everyone we need to make sure that our employees are held accountable also. It's in the employee handbook also registration. [0:48:44, 0:49:04]: I would also encourage all employees to actually to read in depth the state code, the state law, because if I'm not mistaken, it even refers to passengers that may be uh on their phone. [0:49:04, 0:49:13]: Well, so I would just encourage everyone to actually read the state law in depth. Okay. Any further comments from council? [0:49:13, 0:49:17]: Okay, if not so, then I'll tell you what most of the cable. [0:49:18, 0:49:38]: Okay. Thank you. All right. Thank you, Ms. Will. Number eight project assign assigned an agreement to construct the amphitheater. Mr. Maggie, please. Yes, uh Mayor and Council, uh since there are uh [0:49:38, 0:49:58]: potential land acquisition, property acquisition issues related to this item. I would request that we um enter into executive session to uh discuss it further. Okay. Mayor? Yes sir. We move to the consideration uh move this uh item to uh uh to executive session to [0:49:58, 0:50:16]: Fine, fine. Second? Any further discussion? All favor please? Okay, we'll have a second session and come back on because uh make it known what we've discussed, what we can't discuss in the moment. On that note, uh we'll go over to comments. Uh city manager, do you have any comments right now? No. [0:50:17, 0:50:37]: Um just that we've got a lot going on here at the City Stockbridge and certainly encourage everyone to come out to the town hall meeting uh tomorrow evening at seven o'clock PM at the Merrill Manders Center. Of course we have Tasted Tuesday as well tomorrow evening um uh over at Clark Park. Um and so we encourage people to uh come out and uh [0:50:37, 0:50:40]: um uh take part in the town hall tomorrow. [0:50:42, 0:51:02]: Okay, uh City Clerk. Uh yes, Mayor, my comment would be to notify the public that there is no voting or uh the early voting for the uh run-up elections here in Stockbridge, you do have to go to the city of McDonough um to vote. We won't have it here in Stockbridge. Am I to assume that that's the case? [0:51:02, 0:51:22]: We will do so. Apparently they just voted for this last Thursday or Friday. The elections board did, so we will be putting something out on our website. But I just wanted people to know that there's no voting here in Stockholm. Clarification. [0:51:21, 0:51:41]: At uh the regular principles that we're going to do. Yes, there's just no early voting. Right. Thank you. Okay. Mr. Tuller, sir. Uh I just want to take this opportunity to thank all those that participated in the Don't Trash Stock Bridge Initiative, uh, all the departments. Also, I want to take this opportunity just to mention to [0:51:41, 0:52:01]: All of the citizens, I'm going to commend the staff for their due diligence in crisscrossing the city with the comp plan because I think we have to continue to show our citizens, irregardless of the challenges that we're facing, that we are moving forward to providing [0:52:01, 0:52:21]: The highest level of services that we can, and that we're all still about comprehensively uh moving this city forward. So I just want to commend Mrs. Moore and her staff and others for uh crisscrossing uh the city with with the cup plan and the uh other uh [0:52:21, 0:52:41]: uh contractors that we have hired to actually do this. Thank you. Mr. Blum, please. Yeah, I just want to say uh that as elected officials that we're here to serve and I know that this council is working together to do the the best we can for the city of Stockbridge. And that's what [0:52:41, 0:52:48]: that we're here to to do it serve the uh to serve the citizens. Um one of the things that uh [0:52:49, 0:52:52]: One of the things that's troubling to me when those things are challenged. [0:52:54, 0:52:55]: in our community. [0:52:56, 0:53:16]: And we're not standing up for those things that are challenging to our community as a whole. Uh I I would ask that each citizen would look at what's actually going on with our city with our city right now with uh the proposed city of League's landing and get the information to make a sound decision on uh pertaining to this uh issue. Um [0:53:16, 0:53:36]: Um this council right now, right here today, we're here to serve the citizens of Stockbridge. We want to continue to serve you all in the best of our abilities. And uh one of the things I also want to mention that on July twenty-eighth, and I'll mention it now because we are taking uh donations and uh in kind donations, uh [0:53:36, 0:53:56]: uh we're having a big uh back school kickoff on july twenty eighth from 10 to 1. And so anybody want to serve community get involved in that, definitely call the city and talk to uh our Zero assistant Laquinda Jackson and uh we'll love to have you on board. No condo [0:53:56, 0:54:16]: Council Mazan. Yes, uh thank you so much. I'd like to always uh thank the citizens for tuning in and to for being engaged in the community. Uh we have uh a lot of things uh going on in the city that uh need uh every one of you and everybody to be committed to [0:54:16, 0:54:36]: to to moving the city forward. We uh earlier today we recognize the Caribbean American Community and Heritage Month. We recognize Jackie Watson and we recognize Chris Smith. The two organizations are instrumental in what the Caribbean American community does. [0:54:36, 0:54:56]: uh here at Shock Ridge. Um hopefully next year we'll be able to have a full proclamation uh from the city, but I thought it was extremely important for us to move forward recognizing the contributions of that particular community because they always they do a lot and uh we we want to show to continue that push [0:54:56, 0:55:16]: of diversity is more than just words. It is inclusiveness. It is in policy. I also want to say I'm a resident of the Eagles Landing area of Stockbridge. You know, one of the things that I hear come back from the community a lot of times is, you know, why do we love call it the Eagles Landing community? [0:55:16, 0:55:36]: And when you're in Buckethead and you're in the city of Ona, no one complains about the fact that they call it Buckhead. It is just Buckhead. They celebrate the successes of that particular area and they allow it to be its own distinct characteristics. Both different areas of the city do. There's no ill. [0:55:36, 0:55:56]: will or anything cost me allow this area to be identified as that. Honestly in all transparency, for the first three years that I lived in my location with a McDonald's address, I had no idea that I lived in the city of Stockbridge until I went to get my business license. When I went to get my business license, I went to Heron County and they told me, uh [0:55:56, 0:56:16]: You're gonna run a place and you go down to the city of McDonald. And many of my neighbors are in that same position where they're actually clueless that they live in the city of Stockbridge. And um I I I heard a lot of talk. There are three groups, there are two groups. Uh one of the groups is uh you know the city of Stockbridge, the second group [0:56:16, 0:56:36]: uh the Eagles Valley Educational Research Committee. But there's a third group. That third group is the solid majority which represents the people who live in that particular area who have a vote. Those particular people who live in that area, they love the city too. But they do want to see some improvements. And that's nothing [0:56:36, 0:56:56]: Wrong with wanting better for your city. You know, when I ran for office, I wanted to see that. I wanted to see North Hillary Boulevard improved. I think we could have got more there, and I want to continue to work on these particular projects. I think we can have the city be proud of itself, be well, and do, and to also address the wants and needs. [0:56:56, 0:57:16]: Of every area of the city and listen. And that's what I do when I'm out there discussing the boat that is coming up to try to listen and to garner all of the facts and to make sure that each individual that I speak with that I hear them out 100% fully and whether they support the city or whether they support the city. [0:57:16, 0:57:36]: support uh the the the uh Eagles Landing group, I want to understand why it is that you feel that way. And some of the things that we understood was during 2016 I ran for office, those things are what I try to work on every single day. And I want us to continue to work on those items to move the city forward and I think we can do that. [0:57:36, 0:57:56]: Ms. Robinson, please. Thank you, Mayor. Um our youth council is doing outstanding. We just came off a two-day retreat here at Ted Strickland. I just want to thank staff because we had staff that stepped in and just volunteered and supported whatever they could. And also to our city manager, the mayor. [0:57:55, 0:58:15]: And my counsel and my attorney, thank you so very much, especially to our attorney. He actually went through the Robert Roberts Rule of Order to our young people so that way they can equip them for leadership, communication, and team building that we need here in our community. We're building leaders, so we want to [0:58:15, 0:58:35]: students to remain in their city. They are implicit about the proposed city, so they had a lot of questions. They were asking what they can do. So our attorney was there to allow, you know, speaking to them, telling what they can and cannot do. So it's a matter of showing them, leading our young people in the right direction. So please [0:58:35, 0:58:55]: Please, I just want to say to everyone, we're here to serve you, but I wish you would please get involved, be engaged with this council, because you need to know everything that we're doing. Everything. This is your city. And we're leaders, but a lot of times we make bad decisions. So I'm saying to each and everyone. [0:58:55, 0:59:10]: one of you please get involved and that's anywhere you go there's no one that is perfect but if you're involved with your city you'll know exactly what's going on so again I'm gonna leave you with this to get involved with your city [0:59:10, 0:59:15]: Thank you. I'll tell you what, uh last Tuesday I went down a tasty Tuesday. [0:59:15, 0:59:35]: Food truck tasting tooth. And it took me 10 minutes to find a parking spot. Jan-packed with people. And when I finally parked my car and got there, I looked, I looked around, I said, nothing long diversity around here. I said this is a fantastic community.
